001good evening everyone and welcome to the Ashlin planning board meeting of Thursday November 9th 2023 um just a reminder to everyone that the meeting is being broadcast and recorded and um uh some people are also attending via Zoom so first on our agenda I actually I'll officially call the meeting to order at 7:18 first on our agenda as always is the clerk's report we have not received any correspondence to the planning board since the last meeting all right an even shorter agenda than usual all right so we will then open it up for public comment we have one person for public Mark if you could un yourself and just say your name and the address for the record you didn't have your mic on Mark if you could unmute yourself and say you're naming the
002address for the record Mark can you hear us uh he muted he was talking there you go he was talking I I just barely heard heard His Voice come across okay good evening Mark 49 haon Road and um things have been going quietly for the past couple weeks I was just wondering if everything is quiet with the planning board and the comprehensive plan since the last big discussion about it I'm sorry Mark was was that a question that was a that a question to the whole board that discussed it the deep is not there tonight so uh there was a whole board that discussed for over an hour and then the town manager and Brandy came on has there been any peace talks with it yeah the last talk that item is not on our
003agenda this evening no it's not on the agenda but it's be good to know if how how that is I mean we could get to it the comprehensive plant we can talk about it in the reports I guess there there hasn't been a conclusion I can't hear you mark there has not been a conclusion to that topic yet if you recall at the last meeting we talked about having a joint discussion with the select board um that has not yet happened so there has not been a conclusion I can say that that item is on the agenda for our joint meeting with the select board next Wednesday evening okay all right do you have any other questions or comments this evening mark last little that's little and I also was told from the select board
004that the next comprehensive meeting is going to be virtual instead of maybe at the Mendes cafetorium yes or no do you um do you know what format the comprehensive plan meeting has I think the agenda for the next steering committee meeting just got emailed today and Mark I have not had a chance to open it to see if it's virtual or in person I'm sorry so I would I would recommend keeping an eye on the on the newsletter for comprehensive plan and on the town agenda site for that type of information as it's not really in the planning board's purview any other comments or questions no that's it all right thank you all right and a public comment um on to public hearings um first hearing on the agenda is 400 Cedar Street this is
005the special permit application for T-Mobile um Alo not to put you on the spot but do you have an update for us on that yes so uh proudly as you saw in my email we received the peer review uh report that you will find on Tab one of your binder um and also here is Adam who is the attorney of the case so he will give an turn the microphone on please you will give an update on that um we also have an email just kind of like mentioning where this stand um and also I draft de sis um in case we move forward to go on a voting tonight for the case okay thank you oh now I don't have my MK on thank you so oh my apologies actually on tab two oh
006tab two okay I just I was like all right um all right and um Adam right yes and what is your how do you pronounce your last name it's brard brard um if you would like Adam you're you have the mic if you want to thank you madam chair U just for the record Adam brard uh with the law firm of Prince LEL Tai were in uh Boston Mass on behalf of the applicant uh T-mobile Northeast LLC just to remind the board we were here uh about a month ago um where we're proposing to relocate our antennas that are on the top of the tank to the side um that's a result of a couple things we originally went and and started speaking with um the planning staff about just changing out those antennas um
007at that point um Haley Ward got involved and said hey you know it may make sense and we talked about this a month ago that the um since Sprint is leaving that we get everyone off the top of the tank and go on the side where we feel that it's it's it's more of a it's a better it's it's optimal for the uh tank um not that there's any concern with being on the top but um so that was as a result we uh we responded to an RFP that would allow us to do that updated the lease so was we responded to that RFP were awarded the bid entered into a new lease agreement with the town and then filed the application to go ahead and relocate those antennas on the side of the
008tank we last week we talked about the design one of the questions the board had is what the peer review if the peer review was done and what that looked like it hadn't been done yet it's now completed um there are some questions and thoughts and minor changes that the uh that Haley ward has um they say that they're incidental um I I would agree with them but I'm not an engineer I don't have my engineer here with me today um so we can address those um pretty straight forward in a pretty straightforward fashion and what we would do is subject to the board um board's approval we would we would ask the board to consider approving the modification of the special permit or the special permit subject to the applicant um working with uh
009Haley Ward and peer review um and amending the plans before it would be uh issued or even filed a building perit application all right thank you oh Marcel I I I think on the on the information that I read um am I right on on on thinking that the the structural uh calculations have not been completed so we've we've submitted the structural uh structural uh analysis but I don't know if if Haley ward has reviewed that I don't think they have yeah I think I think on the report they say that that that is that piece is is ongoing but it's not completed yet yes so they're still in their review process of of that I haven't seen that yet that's correct so so are you asking us to prove the application contingent on their
010confirmation in their review that the structure sound um like we haven't really seen their findings so how would that approval work I I think you just you would approve the application based on the requirements of the special permit and then subject that to a condition that we comp we comply with the reasonal requirements of the peer review which would so for example if if they haven't because they haven't um reviewed their our um structural analysis which was which was passing from from our point of view or from our um um Consultants um and they had a change there that we would conform with that as well prior to prior to filing being issued the building permit so is is it your position that all the comments that were raised on the peer review that may
011be incidental and some of them yeah they seem pretty incidental yeah I is there any objection to any of the things that they're asking I don't have the answer to that because I haven't been able to because we got this two days ago and I haven't been able to nail down the engineer from from Team over to give me answers on that I've reviewed these I've seen a lot of these um Chang or requested changes before like for example um the cable tray that goes up the side of the tank it's I think it's currently 18 in we were going to replace that with 18 in an 18inch wide cable tray but because we're actually reducing the number of cables uh haly Ward said well can you shrink that by 3 in I'm almost certain
012we can but they're also asking you to put a cover on it for protected so there's there's some scope that they are asking you to add so I guess the question is uh the condition would force you to comply with those requests it would not be uh an option yes there any objection to that well so I think what they these are recommendations and I think that the our condition would be that we would work with Haley Ward and come up with a solution that Haley Ward agreed to and the planning and the planning department and the billing billing department just a way to move this forward if the if the board isn't comfortable with that wants to see final product then then then I I personally don't have an issue but but it depends
013right it depends on um subject to to to whose approval if if if we're saying that those comments and Haley Ward who is the peer reviewer will have the ultimate say I'm telling you you may say yeah we recommend this but but we don't want to do it for these and that reason but if they say no I think you have to do it the condition would have to be under their final say in my in my view uh other than that yeah these type of plans is Is Not Unusual that you can solve some of these things before building permit so I don't have a problem with that but I have a problem with having something that is vacuous and that's not resolved with the recommendations of the peer reviewer that would be the
014only condition in my view and you mean did you mean like the structural analysis that hasn't been well the structural analysis uh would would have is is part of their peview so that's why I'm saying that the ultimate saying if they say ultimately okay everything was resolved and we are comfortable the condition would be that that that would be on on on their um on their approval other than that we we will see it one more time with a new letter I don't know if everything will be worked out even then there will still maybe some some some items open um I I think I think that's exactly the question here tonight like we um the um Greg Aldridge um who who looked at this and and provided the thirdparty review I mean basically says
015um you know that the changes can be considered incidental but that the structural analysis hasn't been done it said that before anything goes forward they have to have a certification um certificate letter um is required from the structural engineer to allow to to make sure it com it um complies with masty EP policy so I think I think it's either there's we're comfortable approving with a condition which Peter has kind of pre-drafted for us a condition that says if in case we wanted to go in this direction a condition that says the the approval is contingent upon a full resolution of all questions um um to the satisfaction of of Haley Warden Greg Eldridge or you know we just make sure the rest of the conditions read as we want them to um if there's
016any corrections in that and we just wait until that's fully complete knowing that we've already read this once and so when it comes back it would just be like okay yep everything's been cleared we take a vote and we move and we move on right so it's it's really the board's decision about I mean which of those two we want to do yeah I mean I keep being being I can't help myself being a lawyer this word like I'm reading the the attorney's letter for tonight you know the engineering team has not reviewed the comments yet would the board be amendable to an approval tonight subject to a condition that the applicant will address the P recommendation so I'm like what does addressing really mean addressing could be we disagree right and kind of working
017things out or addressing could be we'll do it um I mean I for one would like to know the engineering team can come back and tell us hey we agree with 90% of it and the 10% we disagree with hey planning board we think it's not NE necessary and then we would say we agree approved I kind of feel more comfortable with that role rather than just like turning it over to other entities I think it's appropriate for us as the planning board to be aware hey what do you guys actually feel comfortable with after you finish your review and the stuff that's like left let us decide if it's truly incidental I think we do get that Authority um and I'm not sure what the rush is like I think I think it's better
018and cleaner for the planning board to get everything done and set a good precedent for any project that we can handle this we can we can give you a chance to come back with your engineering P perspective and you can trust us to consider that if you disagree with some component of this we will be reasonable people and we will listen and and hopefully we can reach a decision Kate um along that line so what I think I know this board in particularly like Trish has put a lot of effort into making sure our doation all matches and therefore it it never will match our decision if we essentially say this is this is some other entity is making these final decisions right we'd be we'd be going with hay and Ward however maybe some
019things they'll negotiate say it's not that important they won't and so then if someone wanted to see what was finally approved we we don't have that record it's not matched up so I feel like I mean I think is there is it just that not to want to come back to Ashland and listen to our train go by or is there no I could go I that could be on Zoom could I yeah yeah no I think but you still get paid by the hour right I don't I knew that question was coming okay that explains why you don't want to be here I've never said I didn't want to be here yeah the point that I'm making is I I don't think we're giving away to somebody to make the decision what we're saying
020is that this is a very technical application with which we've done a cou before it's not a project like the other projects we do it's it's a project that needs to comply with what the peer-reviewer and that's why we have the peer reviewer we're not going to review every single drawing I mean that's not the expertise of the board we we're relying on their expertise ultimately is the same thing they are going to tell us we are satisfied and we're going to say okay do we agree with with that report or not right right so but it could go way I I'm not opposed to also postponing the and and seeing it one more time either yeah Amanda do you want to weigh in yeah I think I'm inclined to agree with Anna just from
021the lawyer brain to say like why not keep it clean if we can resolve everything that's outstanding I I also I think I I understand marcelo's point and I think I um would be like more leaning in that direction if there wasn't the just completely outstanding analysis from the structural engineer I think that part gives me pause that we don't have any initial feedback at all on that piece and um sort of giving all of that to Haley Ward worries me if we can just serve tie up in a very clean Hearing in a couple of weeks all right well did anyone have any I mean this is this this shouldn't be a time Sync here this evening as much as we have a lot of time to make it a Time sync if we
022want to um let let me first just open up to public comment if any public comment on on this public hearing Mark if you want toet yourself and give your name and address for the record thank you I heard you that time okay yes now I'm I'm gonna ask a couple questions quick ones to the um to the board and then to the applicant to the board first did all the ducks in the road get put in the road before he came up to the microphone or is this catch it up because they didn't get everything in place um I I think we kind of all the ducks have been in a row we we all got the report we all got we all have all the information it's all online so we were very
023ready for for this uh discussion does that answer your question that it's on the board and the uh the upate it seems like um you may want to skip over a couple of things to get this done quick that's that's a comment I have if he wants to answer he can but if not that I'm going to keep it to myself thank you um just just for understanding it's it's not about actually getting um it done quick we are under a 60-day obligation by law to to get through this but um but that can have continuances based on information not being available to the board and that's the situation that we're in here that um the in in actuality the board has talked about this very little it's just then been waiting for the different
024analysis to take place so that we can just follow the proper steps so um all right seeing no other public comments TR on that what is the schedule looking like um I don't remember what the date is today but I or I I don't know what the date is we are right now for the end of of this project or the the 60-day deadline but I know Peter has already talked to you um Adam about about doing a continuance if the board requests one um I believe we're talking about December 1st which puts us at the end of our meetings for this calend well no we'd have one more in December but we have two in no we have two others in wait what's the date so we oh right because we don't have it
025for thanks giving so we have November 30th so it's almost 3 weeks to get this other stuff wrapped up and then have it come back to us on the 30th so I think that was the does that sound right that that sounded like the the request assuming that everything comes back to us before the 30th which seems like a a good amount of time so is that the board's is that the board's I'm okay with that okay I mean there there's a couple of meetings that they have to have with the peer reviewer to review the the the construction documents with the Amendments and the some elevations that we're missing in a couple of sections and the structural analysis confirm the the report from them so yes so I I guess from the board's perspective
026OB we're um looking for everything to be complete okay until we can and then it's a I won't say simple but it we've done these before we where we had these the information obviously and then it's just a vote so do you not being an engineer nor am I do you anticipate the work being able to be done and complete everything resolved by November 30th 30th yeah I mean I think what we need to do is make sure that we get their analysis of our structural analysis well in advance of that that was the challenge this time was that um we didn't we didn't have this early enough to have the right people review it to answer any additional questions that this board may have and just and so I I'm okay with uh the
02730th I think we'll we'll make that date uh we'll make it happen we'll I'll work with Peter and Haley Ward Ward and Greg and and we'll sit down and and Hammer all that out but just from a just to clarify we're not trying to rush anything here we've we've been working with the town for two and a half years on this project um I don't I like Ashlin I like coming here I'm from North Adar it's not that far um I don't get by the hour but I get paid by you know when we get work done um but that's not the issue either it would be um and um so you know we're above board on everything here and we try to make sure we do that some of the some of the and
028part of the reason why we a lot of times when when we're talking about this technical these technical things we look back on okay what's the and I'm not bringing this up because I this board is super technical but a lot of boards are not and so they're just like you know what leave that to the the folks in the in the planning department our view our purview our jurisdiction is the special permit requirements let's move on so you know we when when I'm in front of boards I kind of try to figure out what what's going on there so that's so it makes sense what what you're saying from a direction standpoint what I hear is that you'd like to see what Haley ward has to say about the um structural analysis and to
029see what we can come up with and um review what Haley W's already done what we can and can't do and I think I think there's not going to be hardly any issues here yeah I think and correct me if I'm wrong planning board but I think I think we're at the point of view that we don't anticipate any issues we're just trying to do things in the proper order we're cor keybard yeah um we like things clean but it's not a bad thing because it's a combination of technical people and uh strangely OCD people so just as a just as a but I appreciate I just wanted to reiterate that I very much appreciate that point because I know not all planning board are as active on these types of applications so just to
030look um look at a continuing date we have before the end of the year we're we're meeting on November 30th and then we are meeting on December 14th and after that we're not meeting until January um which is I guess just a few weeks would it be would it be prudent to to make the continuance to December 15th so that if things aren't ready for the 30th we're already continued to the 15th and we just put you on the agenda for the 14th yeah I think that I think that makes sense I mean right now we don't have to do this twice right right the yeah the 60-day shot clock is under the federal rule MH which is a whole another conversation which a lot of these applications actually don't aren't even heard by Boards
031under that requirement um but this town it's the town tank the town wanted to wants to go through the process I totally understand that and respect it so I think that makes sense I think that we will be ready to move forward and uh request the the board again to make a decision on the 30th but um you know if if if we can do that and get that decision done that's great but if not instead of asking for another continuance of the 14th or the 15th we can just do that now sure yeah we'd be happy to put on if everything's ready we'd be happy to see you on the 30th otherwise we have another you know we have another shot at it before having to go through this again so can I um
032can I can I just for the record assume that you're agreeable to a continuance until December 15th yes all right thank you any other comments from the board all right I can great thank you thanks make do we need a motion or uh yes we need a motion to continue I guess all right I'll make a motion to continue 400 Cedar Street special permit applicant T-Mobile Northeast LLC to December 15th actually we're oh we're continuing to November 30th oh to November 30th yes he's giving us the did I use the right terminology okay we're giving the whole project of continuance until the 14th got it continue the hearing to the 30th and project to the 15th of November right the 30th Y and hearing to the 30th of November and project to December 15th that's
033it okay is there a second second and a roll call vote and a testment it's key I Marcel h i Katherine Jersy I and Trisha Kendall ey so that is continued um yeah until November 30th feel free to come on Zoom oh great thank you if you would like appreciate that thanks all right so so that's December 15th I just I hate to keep like you know keep changing the calendars give us some more room um okay so um that get uh leaves 9949 Homer a site plan and special permit application we did get a kind of a late continuance Alvaro can you yes so we receive that continuance today um I believe yesterday I sent an email with the most updated uh renderings and then I as we asked for a complete physical color
034palette so we will have that for the discussion today um the applicant responded that they will not be able to provide that and then in top of that there's a couple other uh outstanding items from the last memorandum that they received from the planning um office and board so they decided to create a continuance uh for November uh for November 30th and for the decision to be until December 15th so on November 30 there will be another hearing and they should be sending all their materials you know timely matter okay so similar to um they're requesting basically the same thing we did for 400 Cedar Street um I have a question about the date because we there seems to be have been a lot of lag time between like responding to gcg and then it
035becomes this cycle and right now I I know the traffic report was been on the gcg for I I think honestly months and now and I know those aren't we get a traffic study it goes to not gcg or possibly both and independent and then there's just a lot of back and forth and I I'm just concerned about the um December 15th date I mean um because we don't control those things but we will just like this applicant want to hear those buttoned up reports and recommendations um so yeah yeah I mean I think in that case um for me I mean the the 400 Cedar Street seems to be something that's should be easily wrapped up that we can that we're ready to vote you know let's you know vote on it by then
036the 9 to 49 Homer in my mind as well is like maybe maybe not right but so those aren't firm even in the case of 400 CA Street that's not a firm date if we don't still don't get you know if those reviews don't happen we don't get the information it has to go out further um so and I think 9 to 49 is that way too I mean I don't know um it does seem to be kind of a long time between I'm not sure why it was so hard to have physical samples to to put those together so that we could had something to talk about to move the project forward but and so my my biggest concern about that is part of that is that site plan which which has a different
037um duration and it kind of times out and they have given continuances but I don't I would like to make sure that we're do don't get sit asking if they're asking for continuance um did you read the way it was worded though which gives me a little bit of just to raise the 15th date I I just have a little bit of concern about that sorry what page where it will be on the first Tab and it will be the first document okay homework got it and then the second page on it I think is the one that Kat is referring to it yeah I mean I don't think it so it's it they're requesting an extension until November 30th in in that I'm not sure we can set I'm not sure we can settle
038this evening I just want to raise the point so we make sure we're careful about dates and timing so absolutely that's the only I was talking to Peter about it today about those so they're they're saying we we want to uh extend it till the 30th right but then we're under that site plan deadline which is extended to the 15th so again I think the I think the deadline I think before was the 30th right and so because they're moving because they continuing one meeting they're agreeing to move it to De they also moving the decision date by one they you know they keep pushing it out so I think I think the thing is that when we next see them that it might be the same situation that this is kind of crazy to
039keep pushing this out two weeks at a time and we don't want to do that anymore we want however long we want so that we don't keep dealing with this every single time we talk to them I don't think we can do that with anyone with no with no one here I agree I just wanted to make sure it doesn't get off our radar to agree the one thing I'll add is I think we as a planning board may want to start thinking about almost like a task memo for these projects when the project kind of moves so many times because in some ways they're documenting hey you're telling us last minute to bring physical samples like they're like oo we're unable to provide physical samples in such short notice meile that doesn't seem to
040be the meat of of of the problem the other issues I think not really the sample but it's funny because of the last meeting we talked about wanting physical samples we we said it at the meeting and yet there's documentation that it's like last minute so what I'm suggesting is when we say things in a public hearing I think maybe we need to document it as well so that it's like hey applicant thanks for showing up here's a report of what we expect so that there's zero confusion and there's actual movement because this ends up feeling like an excuse like oh we just found out you want this that's actually not we told you that at the last hearing like well that's why we I find that frustrating that's why we at the last meeting
041because we talked about this at the last meeting and that's why which we didn't talk about the project it was just a continuance again which is why I created that list or we created that list um and um and none of the issues on that list should have been a surprise nothing came out of the blue right so um so now we have that list and that's not to say other things might not come up but that seems to be our list you know um and um the pallets were on the were on that list oh we've been talking about that for a while right yeah that was not a surprise um so um um yeah so I agree that uh we have a list we're looking to check off every aspect of that list
042you know and Peter as Peter I think noted in an email he is working on that some of the kind of lwh hanging fruit or things that he can take care of other things obviously are in the applicants Court um and so we both need to keep a sharp eye on that list and what's being fulfilled and on the and on the timelines but I get sick of too that we're just yeah just skipping this one meeting down the road when that's it's just not going to happen this is more of a comment in general like it's not really against one specific project but at some point we as a board on special permits can actually deny projects that refuse to give us what we need it's a special permit project we have some jurisdiction
043over that so I I'm just commenting in general I'm starting to see that some of these projects kind of go on forever until they're either gone or until we push them to a point where they're like well we don't like it we're done so it it feels a little bit tedious I'm starting to see a pattern a theme and I just want us to be aware of it no I agree this I don't think that's the case with this project though I hope not it's just starting to remind me no what what I mean is that this project from the beginning from the ones that we've seen lately was the one that had more check boxes from the get-go M definitely and other things started kind of delaying it and now we find ourselves missing
044a traffic study and a lighting plan I mean that's kind of unfortunate because that could have been covered pretty pretty pretty early yeah right but um it's a two-way street I'm sure it's not it's not a linear perfect system either I mean the these things happen so I I I mean I I I I think they are so close I don't think they're trying to delay it it's not in their interest they just haven't completed these these latest requests and yeah so I I think it's a valid discussion we've we' talked about it we talked about it in relationship to 1060 main right so I do think this is a different case as well I don't think it's the same things are going on but I think it it should be um when we have
045the applicant here a discussion about about our timeline that uh you know how how to control that better so we aren't kind of kicking the can down the road all the time which gets frustrating it certainly frustrating for the board I don't know if it's frustrating for them but it's frustrating for I would think eventually they're going to be like we've been in front of you for a year I mean eventually they're going to feel frustrated that we're not do you know what I mean so it becomes eventually becomes a tension Point um yeah that we're always waiting exactly so so forth yeah it's all good I'm it's I want to make sure we avoid a theme that's all yeah like like I said it's come up before so um and this project is at
046that stage now too where yeah so anyway so uh I can make a motion uh I'll make a motion to continue 949 Homer absite plan and special permit application public hearing to November 30 2023 and the decision or the date for the decision on this matter to December 15th I'll second and a roll call vote an A tes miniski I marcelona I Katherine Jers I and Trisha Kendall I so that is continued um all right so we we have I don't know if we have much new on Marcel is there anything new Under the planning topics I know you been involved with Scenic roads or I I have no report on [Laughter] that oh my God I said I was tired did I not say that okay Marcelo oh no I did it again yeah
047I thought you were just yeah I I was just keeping the joke going I wasn't El there's only two men at the table it gets confusing um so for cic roads I we just been a little bit too with a lot of work on the office but um I'm hopeful that for the next meeting of November 30 you know Peter will report that we have sent all the stuff I finished doing the postcards and everything it's just a matter of printing them and sending them out um I just hadn't got a chance but hopefully now that Wednesday is kind of like lower down in the amount of people that we having coming in one of those Wednesday night I'll be able to send all the postcards and kind of just like uh finish up that
048project um for the economic impact tool I know that Peter went to a meeting with them and that he said that he will follow up so he'll probably be giving a more specific report um next meeting and then for the parking memo uh we also have something um ready to submit whenever we kind of like decide to like move forward on term of that but I know that um a couple of months ago like he had me to review and just kind of like go over the last memo that we submitted um and just trying to make it as compliant and up to dat as possible all right um next on the agenda reports from board members and town planner um is there anything new from last time about comprehensive plan that we I think
049the um maybe one knew about it but the we had uh the comprehensive plan steering committee had a a um wind bus windshield tour of the Town um Ed Burman uh is a police officer nurse a bus driver and got us the bus and he does everything that man yeah um so we had about I gu I think it was about 18 of the 29 so still pretty good attendance for a rainy day and a lot lot of good feedback from from steering committee members that people weren't maybe familiar with some of the either Town Projects or building um so I think it was a good a good good thing to do we are tentatively supposed to have a so that was a site visit so there really wasn't allow discussion and we are tentatively
050supposed to have a the steering committee have a kind of discussion about that um we have December 2nd which I think we announced last time there's coming together a little more on a it's I guess I could call it the first public forum about the process will be a dropin open house December 2nd in the basement Town Hall be to see room it's a I guess data Gathering of from specific Town members of specific topics I don't have the details I think that's with the consultant of the details of like the questions so we're highly encouraging um everyone friends family neighbors please encourage them um let's see is that like a during the day Dr yeah it's 12: to I'm sorry I didn't say the time 12: 12: noon to 4:00 p.m. in B Town
051Hall it's Saturday December 2nd I think it's the day of the holiday it's like the holiday walk yeah so and the the um steering committee well the J Goldson the consultant recommended a potential method of getting more participation was to link it with something else going on in town I think we want we I was on I am a member of a working group to sort in marketing and we are careful to say it's it's open house of town hall it's not we don't want to specifically link it with that stroll it's just there's a lot of things happening that day in town which is great and that's sort of not trying to split hairs but the the marketing and publicity is please come to town hall for the comprehensive plan and you might be
052here for some other cool stuff happening is there some kind of material that we can distribute to people to spread the word um there there's some draft materials that were produced by Jam Goldson that I think probably will be released through the um upcoming steering committee okay I I'm on the working group but I think it's part of a group we didn't we didn't get to that level to say who's authorized to send it out I mean Beth Reynolds as um kind of under under her purview has been starting the marketing and so she's sent some but that's a good question I will add that to my okay working group of when when can it freefor all everybody please start sending okay all right great Alvaro is there anything happening with the design Review Committee
053are they working on anything uh no that I seen I know that they met last week but we haven't had any update coming in okay I know they had some other kind of projects they were kind of like signage and things like that they were interested in working on at one time I didn't know if they were yeah I saw that on their agenda but I haven't received any report or like follow up on that okay um sustainability committee um I I don't have anything I could give a quick update that uh we met last week um or actually this week Samantha the sustainability coordinator and Peter and we were just going over a memo that um they're preparing to kind of just like break down the tree bylaw and just kind of like be
054a a complement to it so it will be more specific in just kind of like giving a uh kind of like pointing out what had been the changes since the last time that you guys saw the bylaw and kind of just like having a breakdown and understanding of it so that will probably be coming in for the next meeting okay yeah and at some point meanwhile I'll be working on the um just understanding the new stretch codes um and working with the stain sustainability committee on that as we talked about even back in the spring um CPC CPC met this week um just to really talk about the things that are coming up for them for on the town warrant at um town meeting um and um the other thing we talked about why I
055gave just a little um update on I I mentioned it before that um we're starting to work on some of the properties that CPC has given funds for these include The Corner Spot property the farmers market property the Valentine Barn um there's one on Olive Street um seems to me there's at least one more um properties that CPC has given funds for for and it it gets a little complicated like how those funds are used how how they they have to be used right so in the case of both the farmers market and The Corner Spot um since those funds have been used and the pro properties have been purchased um they're now used for a completely different purpose really than was in was intended right um because just wasn't being used for anything else
056so instead of this the space just sitting there empty it got used for a good purpose now the problem is that in the mean time that the town I'll make an assumption that the town as a whole has kind of now really fallen in love with those spaces and the use of those spaces but that doesn't mean it agrees with legally what that property is supposed to be used for so it's kind of a little messy tangle that has to be undone and a while back um it this Falls a little bit those properties since they're owned by the town Falls a little bit under the select board but the select board being obviously overextended at at this time had asked the CPC if we could start pursuing these things and having a at first
057really the the restrictions on those properties um so that we can kind of get those those things kind of uh straightened out but it's a lot more it's kind of a lot more complicated than that so I'm one of people that agreed to work on it you know because I just think it needs it just needs to be done at least to start the process so I talk to Lisa me about it um to try to understand it from a legal point of view and those those kind of discussions and things are just going to continue as who try to figure out how to you know how to use those properties how we can use them you know and try try to try to get those things figured I don't have an answer just trying
058trying to get more information about it so just to keep you updated sted I will just say Trisha because I know you were instrumental in the success of The Corner Spot um that to be cautious in the sense that because you were so instrumental in making it happen to be involved in trying to kind of remove the Restriction may put you in a hot seat for the ultimate decision so I'm just going to throw that out there that I would advise you to be cautious with that you have made an assumption that I'm trying to remove the restriction not knowing which way you're going yeah just being involved in exploring how the Restriction Works may put I'm just sharing my thought that yeah no it may be a challenging thing and there may be other
059people on the planning board who were not involved in that project that you may want to work with so that there's less questions I understand yeah I understand what you're saying because you were you were instrumental to a beautiful successful Corner Spot project um and so if the end result is some kind of shift of a restriction not because you're pushing for it but because that's where maybe the select board wants to go um I would be cautious I would be cautious in your shoes because then it creates a credibility question or conflict potentially so I'm just throwing that out there I understand I would just um caution not to make assumptions either about not about you either about either about what I'm doing or about like you mentioned the select board so I don't
060think any of those things are actually coming into play really it's just a pure Gathering of data about what the options are good bad ugly right and that's where we are right now if anything I feel like I'm about I'm about the data the realistic options absolutely and I'm not saying that you're acting in a purly what I'm saying is the ultimate result down the line May contradict where it's now like right now it's at the data point but eventually the select board tries to or any entity tries to reverse it it um I for one am cautious about that right about the role if you will um because you you were huge in making that happen do you know what I mean to begin with so all right thank you all right next on
061the uh agenda oh Metro West Regional collaborative so that's yeah there is a meeting on um November 30th so I should have a update at the next meeting see you're going to double meeting that day morning and night be a lot of planning that day are you do you typically go to them I typically so we'll be seeing each other there early morning all right good we got a team okay great um but there's nothing else from there right from now uh no just maybe like a quick note that we met with um Travis and Camille who are both of the people that are running that um sub region committee within mapc um and they're just kind of like going around talking to all the planning departments uh trying to like learn more about the
062communities and just trying to like see what is the best way that they can support us so it was just kind of like a quick conversation to learn more about ashon okay okay I mean can I follow up with that if you guys if so obviously they know and you know we're in the middle of a comprehensive plan so that was one and then two the um MBTA zoning is comes even before that so like did they offer are they is that something there in involved with and do they have any um information that would be helpful to us like in general MC I believe does provide assistance um in any terms I think that if we were to like reach out um for any kind of like topic they probably but I know that
063they also have timelines of where grants are provided for that end so I don't know that I don't think they have like kind of like open Office hours that you can kind of just like go and ask for it um it's more kind of like they have like set times where you will Pro ask for Grants and then they will kind of like provide some sort of like technical assistance depends on that okay and then they do they have any um I mean I think we do have on our website now some general information but do they have any that is better improved since what what we have that we might want to bring to our website about MBTA communities I can definitely like check out and see I I honestly haven't looked in depth
064into like mpc's information on um MBTA um because I've been more working directly with the guidelines that the state provided because I was just kind of working on the model itself uh so we F in that but I'm happy to just go over that and see if they have any extra information that I can add into our website I mean I I don't want you have to research more like when you have these conversations and you said you were meeting them and they're like no we just made this really nice brochure that we've gotten great feedback from other communities that's kind of what I'm asking more than to scrub because I do look at their stuff but just if it comes up I guess because I mean we've had people on for those presentations asking
065for information right so all right cool good point all right any other reports from anything else all right um planning board office planning office updates um for any of the projects I can say that everything has been going smoothly we haven't received any sort of like hiccups on it I know that uh for 39 Union Street they have been working closely with Board of Health so they're moving along um and that's kind of like it we haven't received any other reports okay thank you uh no application no new applications received at this time not at this moment all right um next meetings obviously um our joint meeting with the select board is on Wednesday the 15th I believe they have our time at 7220 um so we will be discussing the um MBTA options possibilities
066I've been working on that with Joe manani and Peter and Alvaro and um so we'll have I think we're very ready we're just trying to make the information really clear so that we can present those things um yeah so that they're understandable and um so and then and then we have right after that is um the uh um discussion about the comprehensive plan um project management team so those are on the agenda for the 15th um November 16th it's not on here is the next comprehensive plan meeting is that right yes so is that the 16th yes so it's our off week right U November 30th obviously is the next planning board meeting followed by December 14th and then uh we break until 2024 um anything anyone has before we oh actually before we do
067the meeting minutes no we'll wait we'll do the meeting minutes first we're going to go through these bios you can leave when you've when you've corrected your bio otherwise you don't get to lock walk out the door all right meeting minutes um they are here the right under the agenda I think on page three line 85 there was some inaudible spelling maybe we can come up with something I think that was supposed to be 4 in clabbered would make sense that's logical there you go um yeah as clabbered is usually 4 Ines yeah this is why I'm grateful we have Architects here when we get to the legal stuff I say the same thing excellent um it's like a game I'm like what is that word clever pattern yeah it definitely Cloud board okay um
068that was my only change that I did not know how to make I will say I feel like our minutes have been better so whoever is doing them good job the only thing I would add is in line 138 when it was talking about the representative to the Metro West Regional collaborative the last line with last two lines is if the members agreed to add this item to the next agenda to allow M Hayes an opportunity to volunteer to fulfill the position the only thing I would add is just to put Miz Hayes the associate planning board member because it kind of floats yeah it's like yeah doesn't say why that person would be appropriate so otherwise I don't think I had any other edits anyone else just this is kind of a silly one
069but I think has been said before um usually when the meeting notes make a reference to one of the members of the board speaking uh they put miss or mister uh but with Anna they go straight to Anna tusinski where where is that I'm so special you yeah line 49 for um I know I we love the the sound of Anna Tes miniski is very but it's just inconsistent with the other I'll be Miss Tes miniski well you know I mean but I don't know if that matters it just consistency is good sure let's do it well like on the first page they say my whole name right Trisha Kendall called the me the planning Bo to order so sometimes it goes both ways well sometimes I think it's like the first time your name
070is used it's the whole name and then after that it's shortened but I'm not sure then I'm fine but I'm not sure if that's the pattern um I mean we can leave it alone it's not a bad thing to like for instance Margie was mentioned on line 30 and as Margie Gastel and then after that she's always GLE so yeah that makes sense oh that makes sense that it might be some kind of um Gat what's it called American Journal like there's a might be one of those what's it called Guides of style manual style things sty yep okay so I guess I'm only mentioned once I object just kidding see Mark Don spell out twice oh boy we really we are really like detailed Bo over here just be uh I think we're good
071I think I'm going to make a motion okay to accept the minutes for September 20th 2023 with the changes to line 85 and 138 as discussed just with changes second a second and a roll call vote an teski i Mar I Katherine Jersey guy and Trisha Kendall I um I will say that the minutes have me as joining late I take note of that and I will try to be more on time waiting for you Anna but I know that you're probably coming in from the city so I didn't oh yeah it's in there it's like there she is coming late you said they're getting B I know it's right there yeah exactly that's why I was only mentioned once you know what I mean I saw that too and I was like h a
072flag right there look at her she's not even there I don't know why that would be I guess I'm not going to fight it it's there we already voted for the minutes and I'm sure it's accurate but I'm guessing saying I was maybe 2 minutes late so next time I'll be like let's time it so all right if everyone I think in the front of your binder is your bio I I I did print it at some point but I don't know what happened I don't know if some members took it but I remember that it was a coup months back no it's not here oh no are they easy to print out no we don't have to do we'll do it next time but M only had a change in one number yeah it's
073true yeah I think would you like us to do you want us to find them online and make edits I think they're online somewhere right I I just figured it'd be easier if we print it out and everyone just but we did it once I remember moing it up Mar actually Marcelo was the only one that turned it back in and I made it up yeah take note this is outside the minute so sorry for you give something to do I'll remember I told you I put more than two decades so it never had to change but now I can more than 25 years are we adding a bio for Amanda I'm assuming okay yeah I don't know if anyone actually reads them but it's good just to have them so we're just trying to
074like see if anything change in our yeah if if I mean may not have any changes but if there is something you know I understand I'll send you no worries no rush and if it's not by Monday I'll send you follow up email I think mine's good as is no EXC excuses you're like going away all right I guess is there anything else before no I think we're good I'll make a motion to adjourn our November 9th hearing second and a roll call vote and a teski i Catherine Jersey and oh and Trisha Kendall and we journ at 8:20 oh officially at 820 yep wow at you wow that is amazing every now and then I
