003in front of you uh the latest design for the Buffalo project. There's been a few changes to the design since the last time that we looked at this. Um so I wanted to uh just bring that to your attention. Um the uh the portion that's colored >> is the new section of the building. That would be all new construction. And again, you'll have to forgive me for the What color is that? >> Gray. >> The gray area. So, the uh architects have come up with a slightly different idea than what we discussed last time. The gray area is the cafeteria. So, they're proposing building an allnew cafeteria instead of a renovation of the existing space. And I think that that's a really good idea because what it's going to do is it's going to create

004a natural separation between the two populations, >> right? >> It puts it's in the middle, too. I like that. >> Yep. And then also, um, we were looking at building a new band room, and that's, um, up in front of the middle school gym. You'll see the proposed addition written with checks. That will get rid of that proposed addition which will save money. They will renovate the current cafeteria and turn that into the band and art room. So, they'll take care of the, you know, the band will get to have that bigger room, but it'll be a renovation of that cafeteria area. And then at the same time, uh, both student populations will receive a new cafeteria. Now again I want to emphasize that this is in draft stage and uh we have uh more

005discussions uh going on here in the uh coming weeks but I just wanted to give you the latest update on the project. And of course that elementary wing that's uh to the left there of the cafeteria that will uh that'll be two stories. And on the back of your paper, you will see the layout for the uh for the elementary wing, the fourth and the uh fourth and fifth grade rooms, third, fourth, and fifth grade rooms that you see, that's the second floor, the kindergarten rooms, and first and second, that would be the first floor. John. [Music] Okay. In addition to the Buffalo design, we had the bid opening for the U. Wayne High School facility roof today and uh that price has come down uh much better and uh so it's under $100,000. So

006which we're really happy with that and uh I'll be bringing that to you. I'll probably bring it to you at that special board meeting on Tuesday for your approval so we can go ahead and get uh it scheduled. The Wayne Elementary School major improve improvement project is continuing. Um if you haven't been down to the school, uh they have uh put the asphalt down. >> I've been there. >> Looks good. >> Yes. >> Uh I was down this morning and they are starting to put the epoxy floor into the restrooms. uh they put the ceiling grids up and have started putting some of the lights into the rooms and uh so it's coming along and again we're here in the next few weeks we hope to be at substantial completion on that project. >> Right.

007>> Um the Benson Middle School major improvement project that's a smaller project which will secure that safe school entry. Um the the uh architect that helped us design that was McKenley. So I've asked them to provide us with a contract. I'll bring that to you probably at your August 12th meeting. Uh, Spring Valley High School, uh, the lot, uh, the paving that we have to do to finish up that project is on your agenda agenda tonight. So, I'll be recommending a bidder for that project from the bids that we've received there. Lavallet roof is ongoing. There was quite a bit of decking that needed to be replaced. Of course, you never know how much decking needs to be replaced when we do the bids. We have them we have them give us a a square

008footage number for replacement and uh uh this was one of the ones where we've had to replace the most decking for the project. So the project price is going to go up but it was sorely needed and uh we're about 3 weeks in on that project. So they're they're getting closer to completion. That's all I had unless you have any questions about anything. did want to mention this isn't a construction project, but we had a big sycamore tree come down at East Land and uh create some damage out there. >> Um luckily it didn't hit the school. Um you remember a few years ago we trimmed a lot of there was a lot of trees that were close to the school. We've trimmed as much back as possible. Um and so we'll be looking at

009that again. But uh the uh it tore the power uh off the prek building and then off a portion of the main building. I believe it's created some I think it might have busted some water lines, that type of thing, too. So we're restoring it. So I just wanted to let you know that that had occurred. >> What about the water drainage thing at Spring Valley? >> You're talking about the uh >> Yeah, that's the asphalt that we're going to do. It's It's corrected. So, if we haven't had any flooding in the last few weeks, I think we're in good shape and uh I haven't heard any complaints. So, the new lines are in. Uh so, I think everything's been taken care of. >> On the back part of the fire department. >> Yep. Right.

So that we um the asphalt contract you'll be approving tonight is to repave that parking lot because that parking lot got tore up so we could put that drainage line in. >> Probably the Did it affect the the little driveway up to the resting rooms and stuff for football? >> No, did not affect that. That's all I have. >> All right, great. I don't think I have any no delegations this evening. So, moving on to our superintendent reports. >> Okay. First up, and we're going to be in this packet, the one with the paper clip on it. >> Yes. >> And the first document in there, uh, the subject that listed on the third line at the top is the impact of OM hold on federal education funding. So, as

011you're aware and we had discussed at the last meeting, uh the office of management and budget at the federal level had placed a temporary hold on the release of several federal education funding streams and uh those funding streams directly support Wayne County Schools uh program services and and a limited number of personnel. Um, and so we've been in communication with the Department of Ed, and I just wanted to give you an update on where we are. So on the middle of your page, you will see the affected federal funds programs, and they are all title programs. Uh, first up, and these are the the there are more title programs that were impacted. I think there's one more on the list, but it u Wayne County does not receive any funds for title 1C, which is

012the education of migrant children. So, that did not impact us. Title 2A is supporting effective instruction. And there was already a budget cut that was coming in these particular items. So you'll see on the paper that we had projected that u we were going to drop from 300,000 last academic year to 240,000 in title 2A. Title 2A is for supporting effective instruction. That money has been put on hold and is not being released. Same thing with title 3A. Uh title 3A is really it's you know we're only talking um we're only talking $1,000. Title 3A is for language instruction for English learners. Uh we are part of a consortium with Cabell County and some other counties and there's a shared cost there and that money gets handled through that process. So that particular line item

013isn't a major impact. Uh the next item up is is a larger amount and that's title 4A which is student support and academic enrichment. So, our allocation for the last academic year was $247,000. We're projecting that's going to drop to $200,000, but again, that is on hold. That money has not been released. And then title 4B is the 21st century afterchool programs, which we partner with Playmates for providing those afterchool programs. um last week it was on the list and those funds were on hold. Late last week they announced that those funds were going to be released. Now I haven't received official word on that but we did receive a communication from the from the state department that they they do believe that those funds will be released. If they are released that will allow

014the afterchool programming to begin uh close to the beginning of the year. Um so those are the uh those are the items that are impacted. So if you look at the bottom of the page, it gives you I it gives you some idea of what those monies are used to support here. Um those monies help pay for some personnel including uh the coordinator of data and assessment. We have a te technology integration specialist that a portion of her salary comes from that um project. We have the math cadre supports uh including stipens for the math cadre and um a uh consultant uh that works with the math cadres. Uh that money is also within those budgets. Our agricultural programs at the middle and elementary level are in those uh projects. And then our we have

015parent leaison at our title one schools. And then we use some of the the additional title one monies found in title two and title four uh to pay for uh non-title one schools to have parent leaison that will be put on hold as well as uh tuition reimbursement for educators who do not work in title one schools and you see the amounts associated with each of those. on the back of your page or on page two I should say you will see the uh the other item listed is professional development services. So when I was given the titles it this is you know academic enrichment and supporting effective instruction. So a lot of that funding is used to support professional development including um inclassroom uh professional development with Carnegie u for the new math curriculum.

016Now, that was very important the last academic year because we had that new Carnegie math curriculum in place, but we were planning to scale it back anyway because we were moving into year two, but uh those monies will be uh affected as well. So, as we move forward, uh again, there's possibility that this funding could be released at any time. There's been a number of lawsuits filed by states regarding the money as Congress had already allocated the money. So, um, what we're hearing from the state department is is the money could be released at any time. It could be released later in the year. Um, but we have to plan for it. So, we've been, uh, having meetings internally to decide what we would do if that money never came. >> Is this part of

017that doge stuff? >> Um, yes, I believe so. Yeah. But it's and it's not the uh it's not the federal department of education that's holding the money. It's that OM office, the Office of Management and Budget that is holding the money. They haven't released the money to the federal department of education yet. So, if uh if this federal funding does not come through, um we do have carryover from previous year's title funds that will be utilized to uh help sustain some of these services and u some of these positions. So, we'll bring you a more formal uh a more formal discussion on August the 12th, but I wanted to let you see the things that we are looking at. We do have quite a bit of of carryover. So, we do think we'll be able

018to support a number of these items. For example, the math cadre supports. Uh we receive teacher and leader induction money from the state. They're going to allow us to use that for all professional development for teachers. So, we're going to put the math cadre budget into that teacher and leader induction budget that we receive from the state. Uh the technology integration specialist uh or technology budget can help there uh pick up the additional cost. If not, we can move that to a title one program. Now, the person would only be able to work with title one schools, but it will work. Um, so we have plan and the coordinator of that and assessment that salary can go to that carryover title one amount. So we have a a plan in place for each of these

019items uh where it won't impact the uh general budget. So I just wanted to give you an update on it. Any any questions? And of course, all of that is fluid and as we receive more information, we'll be sure and let you know. All right, moving on to item number two, staff training materials for the legislative updates that occurred during the last legislative u session. So, I just wanted to share some information with you. These are things that I know that you hear about or hear about occasionally uh throughout the course of the year, but there was and we've talked about the legislation that that passed. Um, but I wanted to share with you some specific materials that we're going to share with uh teachers. And the the first bill was uh Senate Bill 154

020which was prohibiting instruction related to sexual orientation and gender identity in public schools. And so you see that in the middle it gives you a description of the activity that's allowed and not allowed in public schools. So for example, teachers can answer student questions. The teacher may respond to student initiated questions during a class if the topic is contextually relevant. If there's a historical or academic cont context to it, if there's a disciplinary situation, staff may refer to sexual orientation or gender identity if needed to address a disciplinary matter. um or if it's established in an advanced placement program, it's part of one of those dual enrollment courses where it's already established in the college curriculum. So, those would be areas where those type of uh th those would be limited exceptions to uh instruction

021related to sexual orientation and gender identity. What I wanted you to pay attention to here is at the bottom the reporting and disclosure requirements. It says school employees must report the following if a student requests to be addressed by a name or pronoun different from what is listed in official school records for the purpose of affirming a gender identity different from the student's biological sex. Such requests must be reported to a school administrator who is then required to notify the students parent, custodian, or or guardian. Additionally, false or misleading information may not be given to a parent, custodian, or guardian regarding the student's gender, identity, or intent to transition. And again, this is Senate Bill 154, which will be taking effect. on the back of your page is just some of the definitions that are

022associated with the policy and there's uh information about the complaint procedure. Uh but I think probably the thing that will have the most impact is just the handling of when a student wants to be called by a different pronoun than their >> um the fact that that is mandated to be reported. Um we'll be emphasizing that in our training. Let's go on to the next page. The next page is Senate Bill 456 which is the definitions of u uh men and women. So it defines the term male, female, man, and woman based on biological characteristics observed at birth and outlines the use of single sex spaces in public schools. So the big uh the big item here is the advice on restrooms and changing rooms and on school sponsored overnight trips. You will see that

023with the restrooms and changing room rooms, schools must designate multiple occupancy restrooms and changing rooms for the exclusive use of either males or females. Students who are unwilling or unable to use facilities aligned with their biological sex must be provided a reasonable accommodation. Access to a single occupancy restroom would be an example of a reasonable accommodation. Students cannot be allowed to use restrooms or changing rooms designated for the opposite sex unless it's for a custodial medical or emergency assistance or the student is a young child accompanied by a caretaker. For school sponsored overnight trips, it's required that they sleep with individuals and sleeping quarters of individuals of the same sex. Now, we've talked in in our board meetings before about the Fourth Circuit's ruling, and item number three says that the act acknowledges the Grim

024versus Glauchester ruling by the Fourth Circuit Court of Appeals, which requires schools to allow transgender students to use restrooms consistent with their gender identity. This ruling remains binding in West Virginia unless overturned by a higher court. With that being said, the advice or what is required in this West Virginia state bill goes back to number one, which is our county's current practice. And then you'll see the implications for schools at the bottom of the page, making sure restrooms are clearly marked and ensuring that accommodations are available. And again, there's uh other information on that page, but that's the that's the highlights. Um, if we can go on to the third page. This is the subject of this page is Senate Bill 474, the elimination of diversity, equity, and inclusion programs. Um, which is not an

025issue there. This is more of a I think a college level issue. Uh but we will make sure that folks understand that the allowable except exceptions uh to the elimination of diversity, equity, and inclus inclusion programs are f found there at the bottom of your first page. And that deals with classroom analysis of how race, sex, or ethn ethnicity have historically impacted events. Then if you go on to page two, at the top of page two, it says, "Staff are not required to use a student's preferred pronoun if it conflicts with the students biological sex determined at birth. Employees cannot be disciplined or held civily liable for using pronouns consistent with biological sex. Employees are protected from adverse employment action for declining to use inconsistent preferred pronouns. And boards and schools may not adopt policies

026contrary to that provision. So that goes back into the gender discussion. And so there's specific advice there regarding pronouns. And then it there's a complaint process outlined there. And then there is also reporting requirements that have to be met by school principles, uh the county superintendent and the state superintendent in August, September, and October of each year. There has to be a reporting regarding any uh any DEI complaints that occur within the school district. And then the final item I'll mention is um it starts at the top. It says based on the provided text. The other legislation that passed uh that had a significant impact that that passed this past spring was the uh cell phone bill. And so as you're aware, this board acted last fall to enact a cell phone bill. So, this

027is a breakdown, a comparison between the state law and the policy that the Wayne County School Board passed last fall. And you'll see here that the conclusion is is that the Wayne County Board's policy, uh, meets or exceeds everything that's found within the state law. And so, uh, our local policy complies with state law and will not need any changes. So, I just wanted to bring that to your attention. Any questions about any of those items? >> We're good. >> Okay. All right. Moving on. School mapping request for proposal. So, next up in your packet, another item that passed the legislature was the requirement that schools go through a mapping process of all their facilities uh for first responders to be able to react quickly in the event of >> already done >> in the

028event of an emergency. We have done it, but the law requires more extensive mapping than what's already been done. So, we're going to be putting out and we have until uh I believe it's it's either August 1st or September 1st in next year to put >> September >> Yeah. to put the mapping into place. So, we're preparing this as a draft request for proposal. We have sent this to uh the sheriff here in Wayne County and we have sent this to uh EMS for them to review and uh provide us any feedback. Matter of fact, we've already received a little feedback about the kind of systems that they use uh when they're responding to emergencies. And so I've asked for feedback by the end of the month and then we'll be finalizing this RFP and

029putting it out so we can select a vendor. Now, this is going to come at a cost to the school district obviously. Um the state legislature has authorized some funds for us. Those funds are $4,500 per school. So, we'll we'll see how far that goes in covering the total bill, but this is something that we're uh obligated to do because of that uh because of that new legislative code. Okay. >> Okay. >> Next up in your packet is a letter from the West Virginia Department of Education. And I'm uh pleased to say that we received our fiscal year 2025 annual LEA determination letter uh regarding our special education department. And Miss Connley is here. So Marshall, I'll turn it over to you. >> Yeah, I just went ahead and brought in the LEA determination matrix.

030And I have shared with you before um what you're going to see on the first page which is um results from each indicator. And then what the state does is assign points if we meet um the state targets or we meet or exceed the state um percentiles. and then it will show you how many points are possible and how many points were received for a total on that. So that front page is what I've kind of already gone over before looking at our indicators on our ADA report. Um and we you know again reminding you it states at each line which year data year it's pulling from. So a lot of this data is from the 23 24 school year. Um and we have focused um a lot of our attention on that indicator 5A

031this past school year and a couple the previous two. Um looking at getting that LE uh zero increased and then um of course just just student improvement overall which would affect the 3B um 3C and 3D indicators as well. So that's been a big focus of the district in both gen and special ed. Um, so out of the 19 points possible on the ADA, we were we received 11.05. Um, some of them if we didn't meet the state percentiles or the state targets, we would get partial credit for growth in those areas. Um, so of course our department will be honing in on those areas that we didn't make growth and we didn't meet standards to to really look at um making some uh plans to for improvement for the upcoming school year. And then

032on the next page is some more areas in which they look at. I haven't shared this with you um as as detailed. Um but the compliance matrix at the top is just providing free appropriate education and then least restrictive environment disproportionality. And we were able to meet all of those uh targets. Um and then in the second column the measurement uh 11 12 13 and 18 we were able to meet those. Um the indicator 13, the secondary transition, I explained to you that we we did meet it. Um but because we're not on a monitored year, we're kind of scored a little differently. So we will not be monitored this 2526 school year, but we will be on the cycle for 26 27 for our special education um department. Um and then dispute resolution. Um

033we were able to receive the points for that monitoring. We weren't we weren't monitored this year, so those were not applicable. And then the timely and accurate data submissions, we were we were able to do most of those. We we missed a half point on a state um grant error. And then um the state systemic improvement plans that was our office participating in um their community of practices. So we were able to get that point too. So we we were able to come out of needs assistance that we we started this 24 um 25 school year and so for the 2526 we are now at meets requirements >> and that is good news. >> That is great news. So the le the letter that's in your packet that that I had provided you on the

034second page, you'll see the same thing that's at the bottom of page two that Marca provided you is that uh the determination uh is meets requirements uh for the special education department and again last year we were placed on needs assistance. So so to see that bump back up to meets requirements is good. So we appreciate it. And any questions regarding the data? >> What are what are some of the things we did to get those um those numbers back where we need them? Is there anything in particular we did with our classrooms or how did we I guess how did we get there? So looking at again this is 23 24 data but look if you're looking at like indicator 3 A3B 3 C3D those are looking at um some of like the end

035of the year assessment and alternate assessments and so although on most of them we didn't hit the state target we were bit beating the state percentiles so we were able to get points on on most of those areas because we were performing better than the state averages were. Um and then we have again honed in on some of the things on the the back. If you look at this, this is where our scores um came up quite a bit from last year if you look at the matrix from last year. So looking at that timely and accurate data submitted that systemic improvement plan. Um we typically don't have issue with disproportionality in our in our district. So um I'm not sure that there was any growth because I don't think issue before, right? Um, but

036we were able to make gains in that. We've really focused a lot of our attention on transition. Um, so if you look at like back on the first page, graduation dropout rate, indicator one and two, we did not we still did not hit those um those targets. We did not hit state again. The data is from 23 24. If I did the math correctly, we should hit um the graduation for next time. we're still not we're going to grow for the dropout rate, but we're still not going to hit it for dropout rate. So, that's something that in our office, we're really talking about what else can we do, right, to uh really target and um prevent dropout for kiddos with special needs. Um and then our the bottom of that first page postsecary outcomes

037uh we had and the four R and 4C um we typically have a really good response rate and we do again for this year what we're doing it's due in August but at this time we are meeting those targets for that and our 14C um which we weren't able to meet last year again if if preliminary data is correct we will hit that one as well. So, um just really honing in our efforts on some of those uh areas that we saw have, you know, that we have issues and I've and so one of the areas that we're targeting this year, of course, all the ones that we're showing deficits in, but looking at those um GSA and ASA increases, right? I mean, we are we are typically above state, but we're not at state

038targets. So, trying to continue to increase that and continue that kind of goes along with the push that we've talked about before with increasing the L zeros, getting our kiddos into the genetic, getting them exposed to grade level standards and curriculum and maintaining the bar right here, right? >> And helping them get there. >> Okay. So, one of the things that we'll need to do during the month of August is establish um my evaluation goals for the year. And uh my evaluation goals are basically we've coordinated those with the district goals. So uh I have a copy in your packet of the goals from last year and that was approving academic proficiency and instructional reading

039levels at all programmatic levels. Continuing the reduction of the chronic absentee rate. Implementation of the adopted math curricula in grades K through 12. continued implementation of the third grade success act. And then goal four was um to implement measures to improve the district's performance from the 2024 annual desk audit for the office of special programs. That's the report that we just heard. Um so those were the four goals last year. Is there any thoughts on anything you would like to see for this year? And if you don't have anything right now, that's fine. You just need to be thinking about it. And then um probably at our August 12th meeting, I'll bring you an actual draft of the new goals and then we can tweak them as as you would see fit. So if anything

040comes up or anything you would like to see added, just let me know. All right. And then the very last page I received, I always let you have a copy if we receive a foyer request. So the West Virginia Center on Budget and Policy has sent a foyer request and it's uh centered around data regarding Hope Scholarships and the number of students in the county that are on Hope Scholarship and the uh funding that we see impacted by that. So apparently they're preparing some type of reports on that information. >> Do we get that kind of information on who all hope scholarship and who is or is that >> Yeah. Yeah. They have to >> they have to register with them. >> Okay. >> Yeah. So anyway, we'll be putting that data together and I'll

041share it with you when we get it put together. Um, I responded to them today and let them know that it would take us about probably about two weeks to get everything together. >> I'm really surprised that they make us do that since they try to be so independent from the public schools. >> And then the last thing I'll mention and Jeb, I'll let you speak to this. Um there is I guess what two or three years ago the state required that schools uh accept electronic payment. >> Yes. It was Senate Bill that require that all schools have access to basically anything that that they have to offer. fees to sporting event tickets to events, prom events or books or library fees. I mean the list is everything. That time we chose to go with

042school cash online is tied in with school funds online because obviously they go together. state and the Treasury Department is offering same services for free. So that's obviously a no-brainer. >> Free is good. >> There is a charge for people still wanting to use your credit card, their credit card fees. Those fees will get passed off on the person, the buyer. They won't be they won't be incurred by by the LEA here. So >> that applies to the debit cards too. >> Yes. >> Yeah. >> You make a if you make a an AC payment there's no fees involved. It's a debit card. again this AC fees. I've been working through there are several forms we have to get filled out. I've been trying to work through those trying to set up all 18 schools

043and even here at central office. Basically, you'll be able to go to our website, click on the button that you want to transfer money to or make a payment for whatever at any school. We just click on the website, hit a drop down box, enter your name, amount of money, what you're paying for, and that'll get us in meet the requirements from the state from the Senate bill that was passed. Believe it was Senate Bill 712. >> And the the cost for that service previously, Jeb, remind me how much it was. >> It's around 20 grand. around 20 grand annual annually. >> Yes. >> So that's u >> it's helpful. >> Yeah, that'll be that'll be helpful to have an option provided by the state. >> So uh Jaba talked to me about switching over.

But there was a couple things I wanted to point out in the general current fund and fund 11. the year-todate revenue. That revenue was flat with the revenue from last year. And um which was a little bit of a surprise because we did get additional funds for there was 5% pay raise for employees and then there was the uh additional cost for uh health insurance that was being added on that that the state helps fund. But our our revenue stayed flat. But our expenditures had went up. Now what I wanted to point out to

060you is if you look at um fund 71 towards the bottom of the chart, the special revenue, >> you'll see that there was 5.3 million in revenue there and only 2.8 in expenditures. >> Yeah. >> So when we're closing the books on the year, we knew that that that money was going to be there. So, Jeb is going to be moving that money up into fund 11 into the revenue of the general current fund. Okay. >> Yep. >> So, if you compare this report to last year's report, um our expenditures were down approximately $2.3 million from last year, but our revenue was down about 4 million. And again, there were still co funds that were impacting that that that played a significant role in it. If you remember last August, what we tried to concentrate

061on was fund 41 and fund 51. We actually budgeted what we were going to do for the year because we knew that u u the fund 41 last year had had a uh a deficit of about 600,000 in it last year. So you can see that that uh and we had planned to spend more than the revenue for that particular item. So you can see that that was accomplished. we we dropped that number down to about 200,000 over on fund 41. And then if you look at fund 51, it was balanced. So we were successful in addressing funds 41 and 51, but we lost ground with fund 11 because those revenues remained flat and the expenses increased. Now with the expenses increasing, we were still under the original budget that was uh that was set

062up for the year. We were still under that original budget, but the bottom line is when all was said and done, we are still expecting that our carryover amount is going to decrease. Um so our carryover going into the the academic year we just finished was uh approximately 2.7. So with everything factored in um we expect that that carryover amount is going to be under two uh just slightly under two. And so that will impact um as we move forward. So Jeb and I met for about 3 hours today going through the numbers and uh looking at uh looking at those uh looking at those impacts uh on that fund 11 because that's what we've got to keep a close eye on. So on August 12th, we'll report out to you what adjustments we see

063needing to be made for next year and they go forward. But we are it's extremely tight. It is extremely tight. Um so we have to keep that in mind as we go forward. There was also um in addition to that money that's coming up from fund 71 uh we received receipts for the month of June tax collections approximately 1.6 million uh that had not been included in that number as well.
