001that he made some comment on Facebook it was so nice are you ready good evening I'd like to call this meeting of the Fremont County School District 25 Board of Trustees to order it's August 9th at seven o'clock please join us for the pledge Allegiance indivisible with liberty and justice for all we have a roll call please all right are there changes to the agenda item F underneath six um considered administrative recommendation to accept a resignation and action or sorry information item f certified staff change and classified staff changes all right the uh board approved the agenda as amended second okay we have a motion in a second is there a debate all in favor with an eye hi anybody opposed with a no hey our agenda as amended is adopted the consent agenda this

002evening includes approval of the minutes of July 20th 2022's board meeting and consideration of payment of bills including late pays and pre-authorization of payroll utilities officials and automatic payments Madam chair I would move that we approve the consent agenda as presented exactly we have a motion in a second is there anything that needs to be discussed or pulled not all in favor with an i i anybody opposed with a note okay our consent agenda is approved Roundtable tonight let's start with Bruce tonight I don't really have much went to the fair a couple of times looked around some of the 4-H kids oh I got to hand out awards for Shooting Sports that was kind of fun that's cool yeah for the shotgun portion of it anyway and there were a lot of awards our

003kids did pretty well and you know I think that kind of reflects on the schools you know that the kids are doing extra stuff I I like to think that 4-H is kind of part of the school system even if it's not technically tied in though so that's about it okay it's hot yes it is Jody um I actually um a Rec board met on the first of August and um and I I wasn't in attendance but what they they did pass um or did talk about um moving some funds um 200 000 from our checking to the WildStar account um just to make sure that we stay below that FDA approved amount and so I've been working on getting that taken care of as per request through that board um some of the other

004things that have that were that I've done is I I when I went to the fair myself and I walked through and I saw several of our kiddos in the sale ring and and that was really cool to to watch them go out and some of them it was like I didn't recognize them because they have grown so much I mean they've turned into young men and young women and that was always really fun I always liked the fair um outside of that I've just kind of been enjoying life I went to a a golf tournament that is a was a fun tournament in South Dakota with group friends and got to see a few well two of them to the individuals who stood up at my husband and my uh wedding nice so it

005was fun and that's about it for me tonight all right thank you Jenny um went to the fair also it was it was really nice and but it got cold really fast it was kind of surprising at night um enjoyed all the events there see all the animals and all the projects my kiddos participated and placed in all their divisions um enjoyed the tour today it's really neat seeing some of those projects come to fruition as we go get closer it makes me more excited about the auditorium coming up oh yeah other than that same thing waiting for you know waiting for school to start um I can't believe it's already time for our kids to go back um but other than that that's it girl let's see um thank you for the tour I

006appreciate it it's always good to see what summer brings with construction it's kind of a bummer that the sunset isn't completed yet yes I know that you probably had conversations with mayor as you mentioned and I lived out in that neighborhood and it's a pain in the Easter to say the least but I can't met you know going through that little cutoff that they have is going to be interesting you did mention that uh they were going to he didn't say it to all of us but he did tell me that they were going to try to put in the cement work so that the driveway perhaps progress exit areas will be done it takes three to four days for it to harden so that is and so they could at least use that surface

007to get on the dirt go across and down East View or West View and out and around both sides because that little strip mall there also has that that's the same way that they have to get in and out and their customers go in and out that direction too so he mentioned they are doing it yeah and you know you know it's it's hard work is a canal like that yeah yeah but uh they've got it pretty well filled and I think it was you know I was talking to the mayor this morning and he was trying to put out some other fires over it but uh yeah you know it it's coming along and it would be nice when it's finished but it seems like we always have a uh construction right as school

008ends or starts well I know you mentioned that that was going to be used for safe so that the kids from Eastview that come over from there to catch the bus that would be a way to they were going to create that passageway for them to have a safe way to be able to craft the plan was is to have that south side of the road ready to go with the ramp so we can use that side and then come across and and then they will not have any we'll create a safe Passage pass across the road there and they won't have any equipment running or anything going on that you know seven to eight o'clock time and then the three to four o'clock time they'll shut everything down so we can be sure kids

009can get back and forth safely and then as I mentioned and we've been we've been putting information out for for parents um so they know kind of what's going to be happening there and then also letting them know that we've we've been able in the past to accommodate parents who want to drop their kids at the bus garage instead of drop them at the building and we won't be able to do that any longer so um though if they want to drop their kids and not have them wait at the bus stop then they'll need to drop so that's just something accommodate really long term because kieferu who's who's gone in next door doesn't want them they feel like it's a liability to have them parked in there and letting kids out to go over

010so they're kind of like we don't want to do that so it's a completion date on that nobody knows we don't really have one yeah 20 25. they're three weeks out I think yep supposed to be August yeah supposed to be the first part of August it's going to be closer to the end of the first they have three weeks out layoff because of uh some Fiber they were waiting for some yeah and they couldn't get they change order approved by the city council for a bit but that uh that uh that's going to be behind us soon yeah yeah it will be the fair was kind of fun I was bummed out there weren't any ribbon fries this year can you do this too yeah yeah the vendors were kind of I thought yeah

011but the fair was it was fun when looked at the livestock and everything the kids with their photos and you did you can get your photos in you said no I got a printed I just didn't get I ran out of time Dennis got the best of show in uh potted plants yup that Fern got lots of attention that Fern was a big showy no first time in since the Inception of ice I guess they were worried about rain or something they didn't do the bacon or the bacon appetizers canceled the hot dog eating contest our Sports guy really interested in that doesn't even sound like fun yeah he was practicing even dunking the bread oh I yeah that's like that's way too much for me yeah the other thing uh the the uh Caspa

012as you yes uh is putting on I can't remember the date I think it's coming up in the next two weeks there's a thousand seats for member states for Title IX if you're interested it's free to and we are a member of Caspa so if you want it you sign up and it's and if you're interested in Title IX issues and where's that it's uh it's virtually it's online it's a virtual Jada yeah I think yeah we'll share it we'll share it out there's the link yeah Okay and like I said there's only a thousand seats available virtual so it should be interesting it's one of the first things that causba has done out to board members it's always been a state level so this is the first uh National National kind of nice so

013it'd be interesting I signed up so yeah I thought it'd be something to see what they're doing to see how they yeah because it's a different point of view you know if you think of the you know it's not political but yeah you'll see how what would be interesting to see the you know versus this is a company that you know the way that nsba handled uh this was internal and this is an external vendor more or less it's a law firm that they're using to to do their legal issues so they've hired a fir a DC firm of a Beltway firm uh that's okay it's a well-known one to do their this presentation and a lot of the things it's you know where we get it we're used to getting it through nsba through

014the internal we'll skip this from a external law firm and we'll see a different kind of view probably more like what Tracy uh brings to the table by how many school boards Association I think would be interesting to to see that other than that I'm excited to see school start I see we have a a visitor that's in the teaching ranks and uh uh getting ready to go back next Monday right so it's it's exciting the kids the next the following Tuesday so that's fun I go down to Colorado next Tuesday and I'm driving down then on Wednesday I have my appointment to get I'm trying to get both knees at the same time replaced but I'm having a hard time talking to the doctor finding a doctor that will do it so I want

015to have a good leg to stand on I won't have one for a month no he wants it all said and done at one time Joel wrong Joel Joel one all right nothing just yeah okay thanks Jody with an eye so uh traffic is picking back up it's a different kind of busy it's always busy but it's a different kind of busy it's nice to see buildings open back up in office and principals are back and facilitators are back and the teachers help me back and new teachers are here so it's been a fun week thanks where she mentioned the new teachers we actually attended on Monday the the new higher orientation and I've been doing that with Lynn you know as along with Lynette I really enjoyed that thank you ladies for making sure

016that um we could go and attend it was pretty exciting to go see some of those kids and we have a lot of grow your own and returnees in our hires this year which was really exciting too sorry I just wanted to throw that in Joel with an attorney behind his name Square Esquire law from me the team will go into some depth about about the surgeon written by judge Justice Gorsuch they recognize that homosexuals bisexuals Etc are covered by Title IX and that decision was pretty clear that it was limited for facts of that case they were clear about that and this is the keys Tennessee I've been watching in Tennessee versus the United States states have sued because not long after closed off the United States government and should really say the Department

017of Education sent out its dear colleague letters and giving guidance about how you all sorts of issues bathrooms everything well Tennessee and these other states are arguing look that decision didn't go as far think it did and right now there is a stay in effect but there's always a question about the exact stand of this day geographically and substantially so it'll be interesting to see things still in front of it that's eight Circle I think so I'm certain that's one thing that we will be probably the other issue about some of the intense moments with school districts last year annual attorney general Garden took quite a bit of criticism over the alleged use of the Trump terrorists which he didn't use back they were referring to a portion of the federal law to committed them

018to buy assist ance there have been threats made on school board members two school board members in the test School Board administrator I'm not saying that the nsba handled it properly but I am saying that what he said you have to be careful with him because he's a very specific individual if there was ever a judge he's going to listen to everything he says but he carefully qualified if I mean they didn't put out exactly what he said and and from there it kind of went crazy but I think they're also going to be trying to address that at the uh in the Civil Rights division so with these various decisions that have been coming from the Supreme Court in the last six months they're I can't I'm being can that there are certain things

019that lawyers who represented school districts took as Givens that aren't so much Givens anymore and it makes your life a little more difficult than it used to be that's all I have thank you data Matt all right I'll um I wanted to thank Jada and Dallas also for going with me to Thermopolis to the Northwest BOCES picnic two weeks ago now kind of lost track of time been a great time we had a nice trip over and then dinner and toured the cottages and a couple of the kids got to give us a tour it was awesome had dinner um thank you for the tour Jada thanks for organizing dinner um even if we did have to ride the hot short bus as Jody mentioned we were at the new staff welcome it was it's

020always a fun event to see all those excited faces and the ones with the deer and headlights look too they're like oh God we've gotten into um I did meet the new FFA advisor when we were at State Fair sheet or at County Fair she's raring to go and she's doing a great job with those with our kids so we had some great representation of wolverines at fair and I'm happy that that part of it is over and we can move on to school now so uh I also spent a little time at Fair we had a table there and did some Regatta got a few folks rounded up and applications in for some of our support staff bus driver repair Food Service kind of folks and it was really kind of fun just to

021be there I think it's a good idea for us to to be there every year frankly um and because even if we want lots of people stopped by so we had an opportunity to talk and just interact with the community and answer questions about the district and and there was a lot of that that happened um you know even though not everybody wanted a job so it was it was fun um and Jada didn't mention that her and Matt and I judged I think it was sweet bacon treats sweetened desserts something like that so so we judged we went down and judged those one evening and that was fun um and they were really good all of them it was really good there was a chocolate Chuck Cookie with bacon in it and a maple

022bacon glaze over the top and I'm telling you yeah did you have to walk home because it's not fair I had to quit eating it I'm like I have to eat the other two desserts I can just keep eating this one so that was fun we had a good time doing that um I wanted to I I want to just uh talk to you for just a minute about some uh some proposed rate increases at the rack um that I had I asked Christy to do a little bit of a research um after we've gone through everything we've done to bring pay scales up to to pace and get all of that work done um I just feel like we needed to look at that and so she put together quite a bit of information

023surveying um other um centers across the state and we we're pretty we're the lowest probably in the state as far as what we what we charge for entrance so um she would like us to consider a one dollar rate increase um and so I'm just going to give that to you to think about a little bit um I know that that can raise some consternation in the community our pool costs us about 450 000 a year to run um she brings in through her fees about 75 000. so um it it just is it's a costly Endeavor for us our kids certainly use it so we should be paying a chunk of money for it but um it's the community also benefits from it in a pretty big way and it's a very nice facility

024um and the red board contributes some dollars you have to help offset the costs as well so I think it's fair for us to ask you know a reasonable admittance price of the community and I just think it's something we have to consider so um when's the last time that they raised rates that's a good question it's been several years quite a while that's what I I know it's been a long long time yeah I can find that out I'm just curious and I know that so the the fee would go I think believe right now it's two dollars for children under five and for seniors and it would go to three and um for uh students it would go from three to four she would also have a a little bit of an increase

025to our uh group swimming lessons because we're pretty low on those two when you look at what other facilities are charging for that so those would increase as well okay I think they're reasonable increases I just think we have to look at that periodically and and bring that in line with costs and what's the procedure for making that happen I I think we can just make that decision I don't think the board has to act on it but I just wanted I guess to throw it out there because you're the ones that might hear about it and see if you had any concerns and if you're if you don't have any concerns that you want us to hold off or do more research on it or find more out than then we can move forward

026with it I'd just be interested in seeing how much the public side actually costs so you know like there's a cost for having a pool sure but there's a cost for heating it for sure public versus heating it for swim teams just swimming swim meets you know like you go down to the Cheyenne schools they blanket their their pool there's no public use of the right and so that's a static School pool how much above that how much does that increase yes this is the public side and this is the school side we can get something it may not be perfect metrics but I think we can get them okay Carl but I think you had that done I know I want to do it again yeah yeah I think we did have well that

027was a redundant kind of guy that would make logical sense that we would have that number to compare so right now [Music] to them at that point and try to get some half cent sales money I did follow up with their guard and he yeah so we talked about that that piece and then he also indicated he was he was willing when his budget has already been set but when his when it comes time next year to look at his budget he's willing to consider it he said he doesn't which is why I was very specific at our last board meeting about that 77 million budget because there's word on the street with about 77 million dollars so people think we're pretty flush so I think there's you know so I think it's really important

028for people to understand that that we have roughly about affordable which is you know still seems like a very large budget but we're the largest employer probably in the county yes um and so that's the budget goes along with that a little bit so I'll continue to work down that road a little bit and see what we can get election year is a good time to stump for that sort of thing yeah and it's always you know it is a public you know and there is no public amenity part of the model that pays for public swimming no no uh this is something that the school does District goes over in Beyond yeah I don't know what that you know yeah that's a good question right how much how much more is it costing us

029because you know we should pay our parents to run a swimming pool for a school then there's 250 000 cost for the public right because you don't need lifeguards you don't need somebody sitting at the desk you don't need a you don't need to keep the pool as warm as it is so there's all these extra costs yeah the chemicals is different because you're not keeping the pool as warm I mean it's all yeah yeah because they draw you know like so they drop temperature for the meats and then they have to heat it back up and we can we can find find something out around that Carl and we can talk about it doesn't have to happen tomorrow but I don't need a bull's eyes yep we can do that [Music] um new staff

030orientation we already mentioned that we had probably about 60 of our new staff there for orientation we've we've hired probably between 60 and 70 at this point you'll see quite a few for approval on tonight's agenda a really good group um really fun to spend some time with them on Monday morning and listen to them introduce and talk about what what what what they what they wanted to do for our kids and for our community as the year begins so I'll have our full staff back on the 15th and our students back on the 23rd reminder that the district opening will be on the 19th for any of you who wish to come we'll have breakfast ready at about 7 15 and then we'll start the program at 7 45 we'll have to be done

031by about 8 45 so we'll have to watch your time because we have a training starting um some trauma informed training starting with our elementary schools they'll participate in the morning and then the high school in the afternoon so it'll be a busy day for everybody we've talked about the bus garage road so I I won't talk about that anymore we are are doing what we can to get the word out so everybody knows and can be prepared for it and also the fact that there'll be no more free meals this year so that has gone away the Esser funds that were there that provided free meals for the last two years are are no longer available forever for everybody for you to just lunch is still available but parents will need to fill out

032that for introduced lunch form if they need some help with that for their kiddos this year so we're getting that out on social media principals sending that out and information um I am right now writing a parent newsletter so last year you know we started a staff newsletter that we were sending out and Lynette had us a piece of that that she would she would update each time it went out so we're this year we'll add a parent newsletter to that from the district so um I'm working to have that one out on the 16th so I'll put that information in there as well we do have a new alert system so hopefully that's going to work well for us this time we had a little glitch when we were working on setting some things

033up it was live we didn't know it was live so people were getting some really strange notifications we fixed it as soon as we knew and um but we've got a new platform for our uh our uh website that that includes an alert system that's going to be serve our needs much better so we're getting that ready to roll out um and so we'll we'll send that out through that alerts system and hope that that goes well and again if there's any weird little things that happen we'll learn now and then we'll be better set for um for school to start and make sure that's more accurate um we had our kickoff and design charette work for the auditorium today so that was super exciting yeah we we met this morning with the Architects and

034the folks from the state to kind of line out and everybody's roles and responsibilities and talk budget and some some more organizational systemic systemic kinds of things that we all need to be on the same page with and then in the afternoon brought in a little bit larger group that included our theater director and our choir director and band director and Reggie and John from the high school and had more of a opportunity to talk about design and um and and the state was there for that as well and so it's very exciting um one of our big discussions in our kickoff meeting was whether we would go with a cmar construction management at risk um uh delivery model or design bid bail delivery model so the difference between those being that in a cmar

035you choose your Builder through an interview process so the the Builder makes an application kind of to be your your your person to build the building um and so the selection happens rather than through just a lowest bid which in a bid uh design bid build you go with the lowest bid so you design it and you put it out there for a bid whoever comes in with the lowest bid that's who you get um and your design work is really pretty much 100 done so if there are budgetary issues at that time then you have to go back and do redesign work and maybe go back out to bid we just have that we just had that happen to us with the project that you walked through at the career center if you remember

036so it came in about a hundred and fifty thousand hundred seventy five thousand dollars more than than what we'd been allotted um we did a we did a design we went out to bid our lowest bid was 100 175 000 so above what we had allocated to us to spend so we had to go back and do a redesign and go back out to bid and the second bid came in more so um I think particularly in this um climate of um inflation that we're in right now I think bringing the Builder on early in the design process makes sense for us we're going to do a little more conversation Ted and I I've asked for some um I want to contact some people who have done cmar and kind of talk with them about

037the process and how did it work for them and kind of get some checks on that a little bit I think there's some pros and cons to going both ways um but I think bringing in that Builder early allows us to get some really credible pricing as they do the design work so they work directly with the design team when the design team is putting um pieces together they can they can see that they can let them know what that's costing you know what are those materials costing here's here's a different way we could do that with a with a different material that might bring us in better in budget here's a way we could do that design component so they get to feed them that information during the design process and then when the

038design process is at about 90 to 100 percent complete with their input then they give us a guaranteed uh bid so it's not even a bid at that point it's a guaranteed price so correct yeah so they give us a guaranteed price now if the guaranteed price comes in way over budget then we have to make some decisions you know do we do we at that point we could take the design work that's already been done and we could bid it you negotiate that cost so there are some things that you do at that point if it comes in outside you know what the allowable costs are but they know the allowable cost we know what their markup is going to be so they have to tell us that um they have to let us

039know what their markup will be so we know exactly what they're marking up and how much they're marking up um and they still they still bit out the subcontract work so they still bid that out so they make decisions um around the subcontract work through bid process so so we're going to have some more conversations about that I want to do a little more research in it um but my my thought right now is I I feel like given our climate right now um that having them in the front on the design you know kind of boots on the ground knowing what things are crafting they're building stuff all the time they know what costs are right now I I just think that's going to serve us better right right some states have used it

040Colorado was used I don't know projects are gone they don't fit them that much anymore construction now there is a way and there is a way to pre-qualify during that bid process so so if we went you know design bid um build you could pre-qualify the folks bidding but but I think that's a really it's really hard to not qualify somebody so they say you can pre-qual but I think not qualifying somebody is a very difficult thing to actually do so I feel like with the cmar we get a better look at the builders and we can make a decision not just based on their bid early on in the facilities uh commission world they were really trying to get us to to do that model they they actually were doing the qualifications for Architects

041and construction companies and I don't know why it fell out of favor uh if it was political pressure or well one of the things that they talked about today which which John rexus was was with us through Zoom today and and I think yeah John is back yeah so I I think I could Venture I guess that I think maybe what happened is that they were going out for that guaranteed price too early and then there were some issues and so because they're a little lukewarm the state on it they like the idea of just getting basically a bid in which you take the cheapest bid they want the lowest price and I get it that's their job um but but when plan one said we don't go out for the guaranteed price until we're

042at least to 90 percent or sometimes even 100 complete with our design but what you get is that Builder working with you through the design process which they have found to to be pretty effective and you get to select you get to choose your your your Builder based on more than just the lowest price we went through that on Willow Creek to have this contract with the architect and it didn't provide that he be bonded for his performance Mike uh I forget his last name that he represented the state and it's in the Campbell County suits and when they were over with all of a sudden he became a construction expert and he went into I think Westlaw or something and pulled up Construction contract forms but they weren't AIA forms that a lot of

043people were used to seeing on construction contracts I've got those forms because that's what people are used to you put them out there and then you work off those and I think the reason the state is hesitant to do it is they didn't even buy AIA contracts I know that because at one point at one point they were asking me for copies and I said I can't do that it's copyrighted I mean it went into it not knowing exactly what they were doing right that happened so quickly right and they hadn't even allotted money to buy AIA contracts now I hope they have by now because they had real problems with their contracts early on just because they didn't know that they were into and I think that's what's concerned them about contractor contract manager

044at risk we don't have the forms and they don't have much experience getting Mr Rex's back is a big deal yeah yeah that was a real problem they didn't have anyone who who had the experience who had experiencing that yeah and and ultimately it's our decision and um you know so I just wanted to bring you up to speed on that like I said we'll we'll look through some more things we went kind of line by line through the budget allocation from the state and and um and there are some dollars in there there is a there is a a fee that you pay up front to that you pay them up front uh to help with the design process it's not it's not huge um I mean they'll that'll be part of their um

045that'll be part of their proposal to us they'll include how much they they want to charge us for being involved in all the design work so they tell us that but but typically uh down from plan one set it you know it's 25 to maybe 50 000 and um we have some dollars allocated in the line item of the budget that we won't need um so that I think we're okay in that regard as far as of putting some of that money into the cmar so we've already hired the architect design we have and so have they worked I'm sure I'm sure they have done many projects so they probably you know they have all the forms as the architect group and they're willing to shift to it without changing their yes yeah they they

046actually you can tell they prefer the cmar they would prefer that direction they they as Architects they feel like they get a better um they come out with a better design that's more in line with the costs when they have the building in this world of inflation yes think this it's probably it might be a great idea to be able to hand in hand this yeah he gave an example today about a a theater that they're building I don't know if it was a theater was it a theater they were building I don't know um it was a bit it was a large High tall um ceiling and they they had put in some coffered things and you know some really pretty design kind of features and and the Builder said I don't really want

047to put any of my subcontractors up on scaffolding to deal with that you know so how about if we do this with the drywall instead drywallers are up there all the time we can have them do some different cutting we can paint it and he said it was worked it was beautiful it was it was the perfect solution and it saved them and so he said that's the kind of stuff the Builder who's doing the work on the ground working directly with the design team right so I I you know my my thought is it it makes sense um but I did want to talk to a few people and um yeah they're a little yeah they I I I think I mean I just finally cut through everything and said I just need pros

048and cons so I mean I know that there's going to be pros and cons to both so I I said to John why why would you choose to go with a design bit why would you do that if you were choosing why would you choose that because you get the lowest price and it doesn't mean you don't get a good Builder I mean you could still get a good Builder that way there's lots of good builders that build buildings that way so it's it's but I I think particularly in our climate yeah we just did that and it wasn't me and that was not nearly as big a project no so I do not want to do that with an 8.2 I think it makes sense I did to look into it so we'll look

049into it a little bit more and I'll keep you up perfect they'll they'll get they'll it'll be easier for them to accept it because when you're sitting in the position of whoever is running construction department or whatever they're calling it this week it's a lot easier to say no than it is yes to something new I mean if you know it's changes there's no actually fewer explanations are required to say no I think that's probably well and I think early on they had a cmar project where they went out to the for the guaranteed price way too early it may be like 35 percent you know design and and and it was a nightmare so um and and so I think when John when when plan one said we would never go out for that

050until we're at least 90 percent of pushing 100 design complete we would not go out for that guaranteed price I actually think John felt a little bit better about that um they've done this in the past but not as much right not as familiar with that right you know plan one is not at all it's something we haven't done as a district but I think is there any possibility with the statute on bids construction that prevents it because no and it's legal good yeah I have always thought they were a good thing because you get everybody yeah you all knows from what he does you know and people have a right to mark up the materials but some guys just I mean how they rival what they charge is like the code to the nuclear
