please call the role sure Mr griam here miss hen here Mr White Mr chairman you have a quorum thank you uh please uh rise for the pledge get out of the chair here we go oh it's waving that's very nice uh I pledge allegiance to the flag United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all okay um uh M Dr Solen is there any public comment for the policy meeting so far uh there is not Mr Grio okay great I see Tim White has join the meeting as well as his son I won't say his name because I don't know if you can like publicly say a name so I say his son um oh there we go Deon we just
finished bath time so we're putting socks on now but I am listening okay well Jeff um um H as I was asked before the meeting began I was asking if for the title 9 policy here uh if there are any uh Amendment or any Chang to it so I guess you had a a presentation so yeah and I like I said this is this is you know pretty dense reading um yes because it's revision to title n law which is pretty comprehensive so I thought what I'd try and do for you guys is just kind of Hit the highlights and I I have to um say I appreciate uh the work that Tracy hussy put into before uh she moved on um and seeing as I'm in invoking her name I I want to pass
along my condolences as she lost her mom yesterday so my God condolences know on behalf of everybody in the chesher public schools family we feel you know terrible I'm sorry her dad it was her dad oh I'm sorry her dad yeah yeah um yeah and her uh unfortunately her mom is also ill um so it's been a really tough run for her and you know express our condolences to her her mom and the rest of her family um not the bright way to start off a meeting but um you know we have to plow through here our title n update um so basically you know I'm GNA try and avoid going into the deep dark history of Title 9 and all the challenges um the all the you know changes that have come about and
everything and really kind of focus on what has changed between the old Title Nine and and the new and what does that really mean for us um so really it was meant to address a lot of uh sexual uh misconduct issues at the Collegiate level and a lot of uh the law has been tweaked to really mirror uh Collegiate and and U you know public education uh K through 12 so um basically it what's interesting here is that everybody has these assigned roles it's prompt until it's not um it's designed to be Equitable for the the accused and accuser um supportive measures need to be put in place it it maintains a due process and uh speaks to remedies you may remember you know we've talked about Title 9 on the board before but um
really it's about sexual discrimination is at the heart of that so requirements we have to respond equitably promptly to actual knowledge of conduct so you know it's actually a little bit of a higher bar but um we really will will respond our goal is to respond to um any anything that we consider to be um uh and I want to use the exact words here uh the the any potential sexual harassment uh by anyone is really sufficient for the our our trigger to respond um so you know as has been the case we and you'll see some highlights in here things like with the victim to discuss supportive measures in the process and we do that now if somebody were to file a complaint um knock on would we haven't had a complaint uh to
this point this year um if a formal complaint is provided the in and this is Again part of the roles there's an investigator there's a decision maker um and then there's an appeals process Tim thanks Jeff just for Clarity on this is this the legal language you're using and I say I give it I give specifically I'm just wondering like actual knowledge of conduct conduct versus actual knowledge of alleged conduct not to I don't want to get too into Parson Hees butal piece yeah the actual knowledge is the one of the changes in the law um which you know I think folks uh understandably um were kind of put off by that it changed the language to make it like I said almost a little bit of a higher bar but um anyway the complaint
is provided an investigator which would be somebody at the building level um collects the evidence drafts a report for the decision maker we're still working this process out with our our legal team about who that should be but uh for Title 9 uh we were looking about it because of the changes in the roles shifting this process to um a different administrator than it was Tracy hussy um so shifting it away from the PPS director to another administrator and then she the robin would play more of a role in the appeal process um we've already begun Title 9 training for staff uh where in the process of getting more of the word out as we revamp our uh website we will of course like we do on our current website have locations for people to
learn more and file complaints it's just we want to make it clearer and easier to understand with the new law so when are we required to respond again actual knowledge of any of these issues quidd pro quo you're probably familiar with sexual harassment unwelcomed um and severe pervasive conduct uh and then anything that violates um federal law so again we want to um respond quickly uh to address these issues meeting with victim and parents supportive measures are um should the these two individuals be in contact with one another uh you know if if that's the case um the it's the grievance process is really interesting in this whole whole protocol um because you have to follow the investigation process complete the process send results back to the parties for review we never identified previously who
the parties involved were necessarily um directly but now that's a a requirement under this law uh we have to evaluate to determine that make sure nobody has a quote conflict of interest in the process um and it's really only the case when there's an alleged misconduct against the staff member um and then again we have to include a presumption of inoc innocence for the respondent um so what we do pretty much like all of our uh investigations now we gather as much information as we can and then we use that information evidence to identify whether or not it's met the threshold for sex ual harassment under Title 9 and then we and this is the new part provide 10 days for both parties to review and respond um and again a lot of this was
driven by uh sexual misconduct issues at the Collegiate level where you know in dorm life and things get a little bit dice here uh and so there's a a much different protocol though even now for us at at the uh School level so we can offer an informal resolution process for those involved uh both parties need to voluntarily agree in consent and writing to resolve the situation um and we again we haven't had this play out yet in our school system I'm sure at some point it will but um it we don't have experience with this yet so this is kind of the the process there's a notice um that this allegation is out there we conduct the investigation uh we issue a written report and the decision maker um it's not the same person
who's the investigator or the title N9 coordinator makes a written determination and frankly we haven't nailed down who these individuals will be at given the change in the law covid and um change in their title N9 coordinator with Tracy leaving right now Robin is acting as the title nine coordinator but and I would be the decision maker but we're still working with uh still getting to learn the law and still uh waiting to work with our uh attorney to determine you know before we set these in stone uh at some point before the next school year so appeal and dismissal process um this appeals are are limited to uh situations where there may be an error in the in the procedure um or new evidences presided or there's a conflict of interest the the it's
not um necessarily Appeal on any grounds you can appeal based on these grounds identified here or I could be dismissed on those grounds so we have to keep these records for seven years um that's not really uh unique we you know everything in our world has a record retention policy uh so uh we do have to keep these for a for a seven-year period so just to give you a hint to what the um claim you know what the uh the investigation report may look like for example so name date of birth grade identified or not relationships and these are all things that we would typically record what's different now is we make how how the victim feel how it impacted their access to education because that's a component of the law um you know
what was it violative or what district policy and codes of conduct were referenced in the investigation um so again this is the Unique Piece that we stop here and share findings with all parties and allow 10 days for review and ask questions before continuing and that's really unique like for us we you know we don't typically say here's what we think we know what it's almost like an appeal process built in um so then we have the two different roles here again investigator and decision maker um so there are some some wrinkles to this that are pretty unique and so we're you know um waiting to see also what other people learn from this experience uh other districts that may have to do it see what our attorneys learn from this experience walking through it
um and hopefully somebody else gets to be the guinea pig on the process hopefully we never have to use the process but um you know we want to be prepared in the event that we do so we're trying to let other people learn and then we'll implement it uh Jeff we have some questions this a good question okay uh Katherine you were first uh yeah so the notice that is given to all of the parties with all of the information and the findings so far um that is something that is is that become public record or no so but but the students and the parents all have access to that information correct and and I think that's a wrinkle that is unique they oh if you're and once we disclose it uh to party how
does it not become potentially on Facebook in a nanc I I don't know right and um sort of as a followup assuming God forbid it's a it's something that could rise to a criminal sort of situation um I I don't understand how how the investigation by the district uh would sort of coordinate with the police department you know I'm sort of I don't understand what that ends up looking like yeah so when we have situations where uh alleged sexual conduct is violative of state or federal law um generally what we do before we initiate an investigation is to educate the person making the allegation so you know to to help them understand that what you're sharing with us is a violation of Law and you know we we've work very closely with the chesher police
department we tell the victim is this you know why don't you think about this as a mom and dad and and victim why don't you know if you want to pursue this through a legal juncture you can and because that it's if it's going to be legally um investigated for a violation of law then our experience has been that uh a trained interviewer for violation sexual violation of law um should be doing that interview first and not us right and so you know we encourage if you want to go down that road to literally go down that road to to the chesher police department and and go there first and then we can there's separate tracks on our end we do we can do our own investigation as well right so I guess my question
under that set of circumstances is are we legally obligated to go a se you know a parallel investigative track in order to it depends on the situation yeah the age of the individuals the allegation I mean certain things would be um required to be DCF referrals um you know so it really depends on the circumstances but yes we could be required to report okay thank you sure Tim thanks Adam um so Jeff thanks for bringing this forward uh it is a it's important and uh I mean this is something I kind of in a different but similar topic I brought it up in the meeting last month so I'm I'm glad that uh this is getting highlighted here I could have miss this I'm not sure does this relate to only things related to school
what if there's a party on a Friday night totally unrelated to School are we involved that's a great question the um law as it's been kind of Rewritten more explicitly indicates that uh schools must respond when harassment occurs quote in the school's education program or activity which includes location events or circumstances over which the school exercised substantial control over both the respondent and and the context in which the sexual harassment occurs so you know if this were to happen at a party on a Friday night outside of school or something then no not necessarily but it doesn't mean that it can't be bullying or three other things that would fall under our purview and I'll be honest I mean being a high school principal for several years things occur um both in and out of
school that are very delicate in nature um and that we often will consult with our attorneys on the best way to resolve this issue for the parties involved um including us obviously we have to follow the law but we also want to make sure that any alleged victim is adequately protected ating the rights of the accused so it's often a delicate balance on some of these much more sensitive issues okay thank you and um one other point in somewhere in your presentation you mentioned PD it didn't look like Police Department what what's PD stand for uh professional development oh all right yeah sorry yeah sorry okay got it no that makes sense to me I know that acronym I just wasn't focused well in the context it doesn't look as normal okay all right so
you're you're thinking you know other people hopefully will be fast f slightly faster movers on this maybe figure some stuff out your goal is for next year um to get people in place to fill out the different roles for different schools something along those lines close uh you know we have to follow the law now oh sure and so when these things occur we will follow the law in terms of designating you know uh right now we do have a a um Title 9 coordinator and it's it's Robin an carry and you know but we're that's definitely in a point of flux so you know I wouldn't say that we're committed to that for a long time um we're currently monitoring it and we'll consult further with our legal advisors in the in the spring
and then lock it down for moving forward does this by its does this by its nature uh sort of require administrators or could teachers do it no these rules it would be administrators yeah okay um I'm sure you know th those people are trained in and questioning people dealing with situations the legality of these things um so yeah we would it would be an administrator okay they they do these investigations now um it's just a what all this is is kind of like a different set of rules um to the investigation so we would keep it with that group that's much better versed than these things um and and just you know make sure we're following the revisions okay thank you sure uh Jeff so all of my uh training has been in in the
workplace and or for for the workplace context so in this instance this this Title 9 uh policy and law federal law covers both employees of the school system and potentially student to student to student harassment and potentially teacher student harassment any stff member yep any any adult to or from a student and any you know to or from um or to an adult so it there are um and we'll when we flip over to the policy here real quick I'll show you where it's outlined for both Personnel non-certified staff policy revision and also student policy revision right okay and then I guess and then the second part would be um you know in all of our our prior years when we talk about furpa uh if if the uh any of the uh victims or
accused are under the age of 18 how does this new disclo these new disclosures affect furpa is there any guidance on that well it's interesting because you you know the state department of Ed and you have the office of civil rights and you have a couple of different bodies intersecting here that don't always speak the same language so I frankly Adam that's another one of the reasons that we want to try and push back a littleit bit into the spring before we nail some of this stuff down because this is a federal law um I don't have to just wait for something to happen in Connecticut something could happen in Kentucky or any place else and we'll learn from that uh in how it relates to furpa and how it relates to conduct in on
school grounds and what actual knowledge really means um because a lot of times laws um will outline what things mean in the courts paint the the much more detailed picture through decisions and so you know I'm hopeful that by the spring what in areas may look a little bit vague or or in practice seem a little bit wonky uh our attorneys can have had some exposure to to help us not have to like guinea pig this you know when we do have to deal with it so if you guys want to take a quick look at um the the links I can pull up here excuse me a second I'll share screen Jeff we looking at 4000.1 uh yeah that would be the first one the regulation oops and I was looking at this on
my phone I didn't notice the cave uh graphic at the top but so so this is a draft policy from cave that we're looking at correct okay 4.1 okay I have that sorry thanks for your patience so you know basically in the the sample policy um it outlines uh both student and staff um sexual harassment through title n the definitions are the same um like basically you were just saying Adam everything is the same for the adults in the workplace as it is for the students it's a law that um is interpreted the same across the board for all parties so we have both the policies um to revise and the regulations were revising to conform with this new law and to be clear this is um strictly sexual harassment or is there a difference
between harassment and um discrimination is or is it does it cover both things or is it just the Act of harassment and that yeah I think what what the difference is Adam is that in a in a title 9 discrimination case uh the key language being it hinders the individuals access to education um it's it's a discriminatory uh act that hinders their access to education harassment can you can sexually harass somebody not necessarily hinder their access to education but still be harassment um sexually harassing Behavior Uh and I I would say that it in many cases although not always that harassment um stops short of discrimination um that it's not always hindering their access to education um and so that's what I mean like these are sensitive and kind of nuanced very um specific to
the situation uh and I'm sorry I'm not coming up with a good example off the top of my head but um we will often sit down a group of people uh on any really challenging decision we make in our organization and try and run it past two or three other people that are knowledgeable on the area and you know we'll we'll figure it out that's why you know I I know I brought up before central office to student ratios and like why is that meaningful well you have these student issues and they can be you know when you're talking about sexual harassment or uh violations of law in a sexual context you don't want to be out on that limb I don't want our people making that decision on their own um so those things
get kicked up the chain uh pretty quick and we put together a team of people to evaluate that and so that's why I say you know why is students to central office staff relevant because there's less people at the top of the chain to be making these decisions so that's um we we definitely work collaboratively to make sure that we come up with the the best decision for our our district and and our families and our kids but often oftentimes with uh support of our legal team if necessary right so but to be clear this is harassment and not discrimination that's a different level of title n is uh a discriminating discrimination law but it it crosses over here with sexual harassment it's so it's sexual discrimination it's right in the policy the in the
definitions right at the start of the policy and it okay and that's why like I said this is really difficult because there are multiple pieces overlapping here and then you if you want to have even more entertainment here you can throw bullying into the mix and where does this fit into this because you could violate all three in one one F swoop um especially now with bullying um potentially being a single act and not repetitive act so at the at the uh top there you see discrimination when you're denied participation in benefits and programs based on gender uh then you have sexual harassment any of the three types of you know that we talked about quid proquo hostile environment is the the term for the second one and then a sexual assault so they they
really kind of intersect here um and so we we would investigate any sexual anything that could fall into this realm you want to rule it out and just because it doesn't fall here doesn't mean it's not sexual harassment uh or bullying so we start with a very broad approach to these things it could be anything we try and gather the information and record everything and then we as we learn more and more information we see which bucket it fits into and it could fit into multiple buckets and then we pursue those buckets right and so I guess what I'm getting at is because these are very long policies or draft policies all of the language and definitions in here are federal law nothing in here was written by C right this was just they took
federal law and they put it into this and called it policy 4,000 I I wouldn't say that it's verbatim but you know there may be tweaks I mean I would have to check with um what's his name Carol Tony or Lou but I it from having read the law in readit in several places I can't readily determine differences it looks like the law I I I can't I mean because you said like you said it's many pages I it's 37 pages I I couldn't tell you anywhere has there been a a subtle tweak I couldn't definitively tell you that but it looks like the law of me right okay so after so if we move for first raing then I'll we'll make sure that we we still need review just to make sure right yeah
I mean go ahead and continue on where like for example um I'm not sure what page eight it says note the final final Title 9 regulation specified decision maker and the investigation and adjudication of formal complaints cannot be the same person as the title n coordinator or the investigator so is that a note that they added for clarity I believe it is you know but it's it is the law it is definitely the language of the law um so but we can ask him you know where are there anything like that besides the one I just pointed out so yeah these are the yeah yeah the policies um for that are are outlined and then we have um just looking at the Title Nine yeah so that covers both policies around Title 9 the 4,000
being the uh student uh and 5,000 being staff right Carol I don't have that backward right 4,000 is staff and 5,000 is they do have it backward that's why I asked all right okay um so does that uh end the official presentation Jeff it does a bad policy sorry that's a I told you it was meting when we got started yeah yeah uh yeah 35 minutes that's not too bad really considering all the questions and everything um all right so does uh do other members have questions or I mean there's a lot here um so again it's only a first reading get that clarification and come back and take another look at it next month okay all right let me see I lost your scre no questions right now so uh shall we move on
to um our bylaws for second reading does that sound good for everyone we we um had the Personnel certified non-certified alcohol drugs and tobacco missed that one that was at our last meeting if you recall we were really taking a look at this and I um discussing it again with Carol and taking a look at it I I did ask our attorneys to review it because when I had an initial on thefly conversation with them they said well with the legalization of marijuana you know we want to just double check the language on that um and they basically had some of the same concerns you had and I don't have a definitive response to that yet again that's not a a mandated policy change it's an optional policy change so I didn't tell them let's
Rush order this or anything so you know I would just recommend that we table it okay sorry I'm on mute there we go okay so uh so we will uh table that because I did see that you add there looked like a paragraph had been added uh at least I I don't know if that was the initial ad or if that was added after about any uh product derived from uh hemp or cannabis THC or no THC I don't know if that was new language or not or if that no that was the Cade recommendation okay all right so all right so we're just going to table that for now till we get more legal guidance okay great um and uh we do not need to make an official motion to table that we're just
gonna we'll just leave it out there okay all right very good um okay so we we'll pick up uh 93 21.2 do we have to make a motion to move the other one for first reading the other ones um don't we usually do that the we do it at the end I think yeah usually we do the Motions at the end but yeah just do everything at okay all right sorry thanks thanks for bringing it up though just in case but yeah we definitely need to do that um and I forget the difference between the two one was uh 93 21.2 the um Governor's executive order I believe yes 22543 is the one that could be ongoing after if I'm correct right correct okay so anyone go ahead go ahead yeah uh there were a
couple let me pull that up because I did want to point a couple of things out on that the uh bylaw time place notification electronic board meetings uh that you know as you said Adam was that's the the uh covid related and that looked pretty straightforward the um next component though the bylaw attendance at meetings uh that one it's really open to us if we want to go down that road or not um so you know starting first with the um the time place notification of meetings the only couple things I wanted to point out on there to you were uh that it does talk about internet chat discussions um and we you can see those when people put stuff in the chat I would just want to confirm with Mike that you know those
are visible um in the recording uh because I haven't gone back to look at that so uh they are i' I've gone back to look at uh previous and you can see it come up yeah or like SMC that kind of stuff it's not it's quick though so it's not um you know you'd have to kind of know that it was coming or know that it was a you know something that could happen for you to know to know it does show and it will show and it will show in the replay on YouTube so the popup window appears but not the scrolling chat correct okay oh yeah so it's very quick so it's like when you hear the the the blunk the blip sound and I think what we just want to do is
make sure that board members know I mean it's one thing to type in question um and I think that's predominantly what happens people aren't writing a Nolla in the the chat box um but you know understanding that that's not really visible to the public we should keep it a little bit more um cryptic in and and speak you know whatever is on your mind um with the um another component there it says the public will provide an opportunity to make comments in a place so designated in the agenda these comments will be um submitted through the means on the video softwaring now we have done we've provided a lot of public comment opportunities over the last six months we haven't always followed what they're suggesting in the Cade policy which is um that you have
to state your name and everything for the record and I I think I don't know that I pray that we don't see a a time anytime soon where you know we're trying to field a 100 questions in a meeting um what we've tried to do is be very responsive to answering these questions um as quickly and efficiently as possible and getting as many in as we can um what they're suggesting here is that you read the comments you you say like at nine o'clock we're gonna take comment on this you can post your comments by till 9:05 and then you read everything you get in that window and so I think this is something I'm just going to recommend you take a look at that one component I will send you this tomorrow that that
section and see if you w to change anything about that um the ne the last one that I saw on here that you know obviously this is just going to be contingent upon whether or not we allow electronic participation in board meetings for individuals who can't make the meeting post covid um but it says in number seven under no circumstances other than executive order prohibiting inperson Gatherings does the board approve of holding its meetings electronically that's statutorily driven we've had that conversation before the board recognizes there are many time there may be times when a board member for good reason is unable to physically present at a be present excuse me at a board meeting in Conformity with this bylaw a board member May participate in meeting electronically uh subject to the conditions of the
aforementioned bylaw now that's if we adopt that bylaw which is the next item on our agenda so that's the only piece there that may change everything else is hopefully you know pandemic related and won't be with us for much longer um but if there aren't any questions on that piece like I said the only one that stood out to me that we didn't address that's a question is the public comment section and I tomorrow Carol can send you that you can take a look at it for our next meeting um but everything else looks Rock Solid the uh one that would be a more lasting policy is electronic participation in board meetings if you can't make it and I I think part of what we had discussed previously which is really the the Lynch pin
is do we want to allow that or not um and we read through this again and Carol and I discussed it at length the the the choice here seems to be we do it or we don't do it um and then if we do do it the individual who has to be away will simply notify the chair and the superintendent um in advance of this meeting by however many hours or days we want to make that happen um and then we we allow that person to participate you know just my take is on this that you get into um Muddy Waters when you start to say the chair will make the decision if the person can participate remotely or not or you know are we gonna have a a majority vote of the board that
they can participate remotely or not um we've looked at others they don't seem to have any language like that um it's just you know you're you can do it or you can't um so I don't know if you guys have a take on that um uh Tim before you comment um for me um once um you know once we're postco officially however that's deemed whether it's by the the federal government or by the governor um I don't see why this would be necessary anymore because it does muddy the waters quite a bit as far as voting you know attendance and um you know we obviously uh doing uh meetings remotely is it's certainly been a great uh convenience and and of course uh allowing us to engage in safety protocol um but once I guess
we've all been vaccinated or cleared to to meet in public again I I I would think that this would not to meet electronically like that would not be necessary I think uh what was it a few meetings uh ago when cther St to attend that was quite a not to make you feel bad cther but it's just more it was a um an a burden on Mike to have to set up the screen have all of the microphones so that you can have that uh that conversation and to meet all the Foya um requirements that were also required to to meet um you know by St law um so it it creates perhaps an unnecessary burden um a member have that option either you can make it or you can't you're elected to perform a
duty and it's you know either you can be there or you can't um so that I don't know that's just my thought on it uh let's see who's Tim go ahead yeah sure I so I wouldn't want to see it so generally I support the idea of allowing remote and it's the same reasons I gave before I don't want to see anything get abused I don't think it needs to be a choice of the chairman which whoever the chairman is could make it political I totally get that I I think that it just becomes allowed um and it just shouldn't be abused in a way but I go back to what I said a few months ago which is I imagine I'm not the only person who has thought about running for office and it
crosses the mind like can I cross cross my mind can I actually make all these meetings it's a difficult it's a difficult um lift particularly I think I haven't had older kids yet but at least with younger kids I think that's something that probably goes through the parent the mind of parents with young kids um so I think it would provide a little bit more flexibility I totally get the part about the administrative burden on Mike uh but I I think in general I think it would be worth while as long as it doesn't get abused by people so I you know anyone makes a choice to run for of Ed I think there should be an expectation that they would be attending meetings on a regular basis and be available to the public but
I also think that there's certain times when you know you can't get a babysitter for whatever reason and you're not going to be bringing a four-year-old to a meeting that's going past nine o'clock yeahp but the Topic's important um and so that's where that's where I'm coming from Catherine go ahead so um I was thinking yes I've agreed with Adam um in his um analysis and now I'm hearing what Tim's saying I'm just wondering if you could have a policy that says that you know you a board member can sort of make that election like once per school year or twice whatever it is like limit the number of times that a board member could participate remotely but and however it should be for a good reason because it it is burdensome and I know
exactly what you're saying adamy when when I participated um it was it was cumbersome for for all concerns so um you know but I know that there are times when there is something important that we all want to be able to you know participate in the discussion about you know a particular issue or or actually be able to um cast a vote and you know if there's a really good reason but then who decides what that is so I guess maybe I'm heading back to it used to be that we all had to be there or not and you know until covid came along and we had this you know everybody got used to these electronic sorts of meetings um if you couldn't make it you couldn't make it and you know I guess to
Tim Point um while we may want to encourage as many people as possible to run for office that there is a respon you have to be willing to make the commitment and um if you have to miss a meeting because of something like you know you don't have a babysitter or in my case it's usually because work interferes then that's that's a problem you know I mean that's that's on me or whomever so um so I've talked myself around into a total Circle um and I I guess I think maybe it's too much of a slippery slope you know it just could become very unmanageable so much as I'd love to have the convenience if necessary maybe it's not worth the a you know not worth the aggravation from a number of you know sides
um Jeff to be clear we're talking uh we're talking about 9325 is it yes only like six paragraphs right yeah and uh so yeah so I'm looking at that and it's like there's still a lot of stuff here that just in these paragraphs that I think would need to be massaged as far as you know right now board chair is still in there um at the end it talks about uh having a roll call vote because someone because someone is there and that's not necessarily um uh that doesn't necessarily coincide with Robert's Rules as far as a requirement usually uh a roll call vote is something that the you know the chairman or or the board would determine if they wanted a roll call vote usually a motion is involved in that not a bylaw
um so there's a couple of things in here that I that I question I think there was some reporting requirement as far as something about town hall if I recall I don't know so yeah so there's some things in here that that I think we may want to take a look at before we even progressed it to a second reading anyway um so I think uh we should we should PA at least pause on this um on and just and as part of our report part of my report at the next business meeting to sort of discuss what we talked about and and see if there's an appetite for it to continue um and and if so then we can really work massaging it to to make it workable because right now I think it's
a little raw in its current form so um do do the rest of you agree that we should pause on that one for now yes yeah okay all right so we we'll pause on that one um yeah fine with me okay until we have a a better feeling from the whole board is to see if we should continue with it or not because if not then was Wast yeah well I think just a couple points to keep in mind is I mean this could who knows how long a covid goes on you know the governor the legislature could make changes themselves on this I don't think that's I don't think that's crazy or farfetched um and also technology is changing too and you know I've had people say to me like why can't you say
you can't have your meetings in humiston or whatever online can't just use your phone for FaceTime or whatever it might be I I really don't know but I mean I see the point that people are making which is technology is improving rapidly so even if it's not something that's you know administratively too burdensome on Mike right now you know a year or two from now this stuff could be out there where it just the expectation by the public will be do it right and like for me like I love I think these meetings that are on um these the zoom or um or Google gole meet um are more engaging to the public and if you want to go back and see something you can hop on YouTube because we we we're allowed to put
these on YouTube go back and review a meeting if there was something of Interest or public disclosure a lot easier too so I don't know we'll see we'll see what happens um so for now um I guess uh we can move forward 93 21.2 because that one is just sort of administrative requirement at this point um where the other one could be more long lasting so we'll pause on 93243 so that being said uh Jeff would you like to move on to other section I'm guessing you have some reports there actually oh yeah just a point uh before we move on to other stuff do we want to make a motion because I thought we had one going to a first first reading one go into a second reading or do we do that at
the end because um yeah I mean you know what before I forget why don't we just go ahead and do it there's no requirements to do it at the end all right so uh who would like to make a motion um for the uh uh 4,000 oh no we're going to pause oh wait no I think four 4,000 we doing a first reading and then 9321 a second reading yes is that it CBD okay yeah pausing pausing on 4 5145 we we have to make sure both are in there because it's the student and the staff versions of the title n okay so who like 5145 yeah yeah yeah okay okay yeah all right so who would like to make a motion on uh the first reading I mean I can't go ahead Tim go
ahead Tim so make a motion to send policies 4,000 400.1 and 5145 point4 to the full board for a first reading second do I have a second Katherine a second um okay the uh the motion is to send uh policy 4000.1 51444 uh to the full board for a first reading um is there any further discussion um seeing none all in favor fantastic all right um motion for the uh second reading Tim go ahead uh yeah um I make a motion to send policy 93 21.2 to the full board for a second reading second uh motion on the floor uh to move policy number 93212 uh to the board for a second reading um is there any discussion uh all in favor it is unanimous fantastic okay um um and for the record we are
uh pausing on uh 18231 421 18231 and uh pausing on 993-2543 for uh further guidance or uh further review okay Jeff into the other section all right so um two items you know we talked about employee status notifications uh and incorporating that into the superintendent report at board meetings which I did the other day um talked about any staff that were coming or going so you know that's kind of what we plan on doing just moving forward based on the conversation uh the certified staff who came and went and what their their status was the other item that we've talked about previously um and I'll share with you right now is the um the coaching certification process as we've talked about before basically um our protocol is such that it at the onset of the
season um whatever season we're in the athletic director and principal at the high school meet to they first of all review all certifications and meet to confirm confirm that they're settled and then they send that to um Vin maiana and we review that to make sure where is everybody is everybody all set um if you saw the report from um the Hurst media Connecticut Hurst media they found over a hundred coaches without certification in the last couple of years in in um in New Haven and Fairfield counties um you know makes ours look pretty poultry thankfully but we don't want it to happen to us and um so as I said we revamped this protocol and this is what you know this is basically what it looks like on the administrative end where we have
um not just coaches but also volunteers um gaining their certifications so this is where we are for the winter as you know uh the state has put a a freeze on all winter sports maybe freeze isn't the right word for winter sports but um they've paused the winter sports until after Martin Luther King day um so right now we're not playing anything obviously no groups larger than four um but when that um you know I'm thinking this month uh nevertheless we will look at the spring season um and I know I've mentioned to this group before some of the other changes we made is right on the teacher evaluation or the coaching evaluation form uh at the end of the season we've changed it to include the date of certification expiration so that that needs
to be filled out and it's just another set of eyes on it at another point in time to make sure that it doesn't get missed and um you know I I know Steve uh lost a lot of sleep over the situation and um came up with a positive Solution that's worked well for Mary and for uh us as well that's yeah looks like that that reporting um uh seems to be uh working well um do we have the fall a report too uh for I wasn't there there was volleyball and I know football had practice so I'm guessing you still need to be certified to conduct a practice Yeah pull am I shoot um while you're looking so um so how was it uh how is it certified does it is it because does the
report gets sent to Vin like from Mary's email and is that that what you use as a certification saying that since Mary sent it via email that it's assumed that she and and Steve went over it and that's how you're certifying it or is it a physical signature or how no it's it's shared through a Google doc and you can see the revision history so you know it was shared but um because it's not always always necessarily shared with me I'm having trouble pulling up the fall one okay were we given that document because I didn't see it I could have missed it okay let's see if I can find it here well if you don't have access maybe we could just put in the minutes that you'll you'll share it at the uh the
business meeting perhaps if you need to get access to the actual report uh ongoing it's make only Vin had it or something like that yeah because I think it was shared with vin I mean I I mean I can get I asked for this one for this um for the purpose of this meeting I didn't asked to go back to fall because I know that was already resolved that was already yeah completed sorry all right so yeah maybe we could get it for the business meeting that'd be great sure okay um all right so that'll be noted in the minutes um is there any other business to be brought uh uh to the policy subcommittee okay um seeing none uh I'll uh entertain a motion for adjournment oh that so I was that a silent
uh motion motion to adjourn sorry okay now Katherine I see a second uh is there any discussion on the adjournments seeing none all in favor all right is unanimous this meeting of the policy subcommittee is adjourned thank you everyone thank you
