001thank you Carlos Mar if you can help us with the roll call today is a regular board meeting of September 9th 2021 at 5:30 p.m. members of the board and attendance president Cora present vice president Andres Quinto thank you help us with the roll call you caught me saying present correct yes I heard you and I don't know what happened there was like an echo of you the um sorry I had to mute the um YouTube because it starts echoing off um clerk Ernesto Beano here member Linda Chavez present member mfam here members of administration superintendent Dr Bower present thank you and at this time if you can join me in the Pledge of Allegiance I Pledge of Allegiance the flag United States of America indivisible liberty and justice for all all right and today
002I'd like to open up in honor of uh Linda thank you for mentioning 911 but in honor of all those that have served our country um and especially those that have lost their lives in one way shape or form um for each and every one of us to continue to be here um and that goes from military to our ancestors who fought hard um you know all that that represents for each and every one of us here um and our children to uh continue to flourish um in all of our alumrock community so we just want to honor um that at this time and then uh with that I'll go ahead and move on to item 102 discussion and or modifications of the agenda do we have any modifications at this time I see um
003trusty fam uh yes Madam president uh I'd like to move that we consider item 5.02 before 5.01 okay 5.02 before 5.01 okay I'm sorry go ahead and but I'll be next ask for any other changes on the agenda agenda before we yes um on the agenda on the Travel it's actually 1995 for the conference and the um hotel and the and Linda we'll go to that um I think when we call that item but do you want to change any items um on the agenda in the format that we have them in I guess just the amount that's the only thing I want we'll get to that the order the order of the agenda if you want to hear any items in a different order um but definitely good information Linda let's make sure to
004bring that up when we get there to item 501 uh but at this time just uh any last minute changes anything that we want to change uh Dr Bower I believe that we had talked about moving something and it's not coming to me and that you might um but I mean um Madame President I think it was in close session actually I just remembered it was the teachers um the recognition of the teachers and uh and the school administrators I just uh I'm hoping that our teachers are joining us and I know that sometimes our meetings run late and sometimes some of these items run late so I wanted to honor their time and see if uh you were all open to moving 701 before comments and communication um in case our teachers are joining
005us I know they have a long day at school already and so if they are joining us you know I'd love to um honor them I know you know uh we have a teacher of the year but we also have a list of teachers so just in case they are joining us if we can if you all are okay with moving that before 701 mainly 701 uh because then the week of the school administ will be in general so we'll just uh 7 1 before 301 so at this time just to repeat um the changes 502 before 501 and then 71 before 301 any other changes or to the agenda modifications okay I'm seeing none uh we do need to vote on that right unless yes no okay we're on AG grp sounds good okay
006so we'll move on to item 103 um just a reminder you uh the audience here the public will all have an opportunity to speak on each item um when we call that agenda item we will be giving public common time you'll have two minutes um unless there are more than 10 people uh then we might bring down the time but typically we H we've had no issues with that but that is in there just in case um so with that uh we will now open it up to oh me I did see your hand up did you want no no no no that's that's not okay so uh now we'll move on to 2011 public members who wish to address a board on matters that are not on the agenda um you can request to
007speak at this time if you can raise your hand and Jose will help us identify who is here for this item hi madam president uh at this time we have no public speakers okay I'll give a couple seconds yes we have Miss Sandra Rivera Miss Rivera you have two minutes please unmute yourself when you begin speaking the timer will begin good evening members of the board my name is Sandra AA I'm a t teacher at Chavez and I was just calling tonight um to ask that we take a look at our decision making um chain that we have I had an incident happen this week in my classro that has left me very unsettled and very unnerved we have siblings and one of the siblings is out and I was not informed which I understand
008I do not need to be informed on why the other sibling is out but at the same time on my attendance there was a mark next to the child meaning that there was communication with the office and my that child should not have been in my classroom and then the child was allowed to come back into my classroom for the last two days when they still had not done the 10 days worth of quarantining and or gotten a negative covid test from the onset of the symptoms and so I had to do the protocol but I was not informed that I could have been a possible contact through the sibling none of my class has received a letter on why this child went home after having been in my classroom for the last two days
009and so this is why the teachers are unnerved and are having an issue and not feeling safe in our classrooms and in our schools and with our students because we're not having that communication and so I'm asking that you guys please take a look at those decision trees that you do your chain of command and that you guys go over it again and make sure that everybody knows the proper protocols when I call and I ask why this child is back in my class with an O and I'm told oh it's okay I'll get to it later it's not okay that child stayed in my class for two days when they should not have been thank you thank you Jose do we have any others yes our next speaker is uh Kimberly doie miss doie
010you have two minutes please subm yourself when you begin speaking that timer will begin mute okay can you hear me now yes okay um uh thank you board members um good evening uh my inquiry this evening is about um the collapsing of classes and um M and then making classes at the capacity at the town hall meeting it was told to parents that lower grade classes would be up to 24 but it seems as though some classes are over the 24 cap and um in in covid and we know already that covid is breaking is becoming an issue within our district that we crowd the classrooms um parents were told that we would not CL crowd the classrooms and I'm just not sure why in in in in this year of covid that we would
011overload classrooms to capacity and over I don't understand the reasoning that we would do that to keep the classrooms under capacity would seem to be the most um beneficial to the health and safety of both students and teachers and staff so I I I ask you to defend why collapsing classes and filling them to Capac capacity or over seems to be a um an issue an event a thing that the district is doing this year um also I was also told that it was because there's not enough independent studies teachers and if you would not have made independent studies so punishing as to make them be involuntary and at risk of their jobs maybe more teachers would have uh signed up for independent studies without the punitive um uh things that were put on them
012thank you our next speaker is Miss Adrien ban Miss ban you have two minutes please unmute yourself when you begin speaking the timer will begin um hello uh my name is Adrien vain I'm a teacher at Joseph George Middle School um I want to say one of the things and this may you would think as a union member I wouldn't be on this side but I don't know who made the decision to get rid of our vice principles but our admins are not able to do their jobs and it is affecting the safety of students on campus and we can't get the supplies we need or stuff we need because our principal is busy subbing classes and she can't get she's she's one person and so um that that's upsetting to me the fact that
013I am a vaccinated person and so are my fellow colleagues and I can't eat lunch with them but I can be in a class with students that haven't been vaccinated I've had kids in my class test positive but I have not been told specifically that somebody in my class tested positive and uh I I know that I I it's the class size is we have over 31 at our school we have some classes with 35 kids in them there is no room for me to socially distance with these kids because there's just no room in my classroom and so I know that you guys still are negotiating the safety mou but these are some things that I would really like you to guys guys to look at and I know it's very hard for you
014and there's stuff that you know you maybe don't have control over but there's stuff that you do and there are things that you can help us with and I believe you know if we all work together we can feel more comfortable with all of this so and we also don't have a nurse at George as well so we're out quite a few people thank you very much I appreciate you're listening to me thank you Miss our next speaker is Miss Jessica leod miss leod you have two minutes please unmute yourself when you begin speaking the timer will begin hi can you hear me perfect um I just want to reiterate what my fellow teachers are saying it's like Russian Roulette every day it's it's so scary and so unsafe and everybody on Camp us especially
015our principal and our our admin in the front are doing the most incredible job of subbing and tracking covid and and you know going beyond what they have to do and because there's just no staff there's no Paras teachers are out um and our class sizes are flooded and that goes against the fact that then we can't mainstream our sped kits you know because their overc capacity um and parents are worried because their classes are packed um we don't have PPE anymore where is the PPE where are the masks where are the hand sanitizers um it's just like what is going on um windows are glued shut teachers still can't get their windows open um and the open communication the fact that we'll get one notice for an exposure but that could mean five kids
016or 10 kids or eight kids um so it doesn't tell you who how many kids it is you know what grade it is so it that also and it's not done timely enough and then it's up to the principles and the front office staff to do all of this why isn't there a designated person to do this to keep track of it um and then on top of that we're in the middle of negotiating our contract and we as teachers are literally risking our lives and our family Ames and our kids and it just seems that we're just compacted even more with safety hazards um and to why are we doing this you know we have Co relief funds that we shouldn't be cutting Corners we shouldn't be cutting and and having a lack of
017masks oh thank you thank you Mr OD next speaker is Kimberly do miss OD you have 2 minutes please unmute yourself when you begin speaking the timer will begin can you hear me yes okay just to pay you uh back off of my colleagues I just want to let you know that at our site at McCullum we still do not have an attendance clerk we have a new secretary um and we don't have an attendance Clerk and that means it's over overloading the office um I we were told that we would be getting an attendance clerk but that has not manifested yet at the let me just re um um reassert that at the town hall meeting uh it was told that uh classes would not be overloaded but yet that is not the case
018when teachers are out for legitimate reasons there are not enough substitutes now parents don't know that that the classes are being distributed to uh other classrooms which means it puts us over cap and we because of collapsing classes we are overcap now the parents don't know this which continues to make a a distrust in our district that we say one thing but yet we do another um you know there's been a buildup of distrust towards our district from the community because of years of problems and concerns and issues so here's another example of a distrust that will manifest from our community to our district because they're being told one thing and yet another thing is happening we are overloading classrooms collapsing classrooms we don't have enough substitute teachers the students are dispersed we are overloaded
019we're you're willing to pay us for the overload but you will not adhere to the promises made to the parents of not overloading the classrooms again you tell the parents one thing and you do another we already have a problem of distrust mistrust from our community towards our district I think it's time you start to rectify honesty thank you thank you our next speaker is Sean swe Mr s you have two minutes to speak please unmute yourself when you begin speaking the timer will begin all right my name is Sean swis I work at dorsa make this quick um today I had the heartful notice that one of our new teachers was reassigned after 15 days of getting to know her fifth grade kids there's a small classroom and she knows and as we know
020in elementary school our kids are way behind my kids in third grade are a year to two years depending on what subject I'm GNA have a very tough year um so I'm just want to let you guys know that I think our district does that the service by not telling new teachers there is a possibility that they could be reassigned somewhere else and this year especially could be reassigned to doing independent study I feel bad for this teacher she she's going to be a great teacher and or is a great teacher she comes with eight years of experience from another school district she was hired it was told that she would be in a classroom now I don't know what parents or what board members have or kids at their at school just think if
021your kid was reassigned after 15 days where they're just getting to know their teachers and now they're pulled away I hope you know I hope it doesn't happen to your kids and last but not least as we know we don't have enough Subs I know pay went up finally to $200 I have I have an offer I hear that everybody in the people in the do can substitute now I heard Mrs bow you that you substituted in a TK class I heard is that true okay well why don't you make an offer hopefully maybe you will be coming to the middle schools or coming in to see what we're fighting about this year about having no subs in these classrooms so board members please look at what they're doing and try to also settle get
022our contract settled thank you thank you Mr our next speaker is Miss Brenda sendas missas you have two minutes to speak please unmute your microphone the timer will begin when you start speaking missas if you're speaking uh your mic might not be on yeah sorry I could I barely was able to unmute myself um hello can you guys hear me hello yes we can hear yes we can hear you miss hi my name is Brenda has um I have two children in this school and they are both an independent study for personal reasons and I'm really sad that they have been not given the attention that they need um there was times where my son didn't have um anyone and he was waiting there and so sad and they have different grade levels in one
023group I don't know how this works how do you have second and fourth grade or fifth grade and Middle School in one group um the work is not for a second grader I'm just disappointed in that know this is new but I just want to make sure that you guys know what's going on with independent study as well we do have a group of kids that cannot go to school and they deserve the right for a fair education like everybody else and right now they don't have teachers and I understand we have a short of in teachers and I just want to say that thank you to all the teachers that are hanging in there it's been very tough I've seen everything you guys are going through and I empathize with all of you um
024I do want the board members to know that you should visit our schools and see exactly what's going on because it is really sad how we are failing our kids and not all Protocols are being followed um I would love you know for the distancing but there's they elbow to elbow in class and in the caeria CO's getting worse this isn't a game and we need to prioritize the safety of our kids and our teachers and our staff and one of the things is sanitizing soap has to be there at all times and ensuring that the classrooms are being cleaned every day every single day and I'm not sure that that's happening thank you thank you m has our next speaker is Jeff Jeff please unmute yourself when you begin speaking that timer will begin
025you will have two [Music] minutes hi this is uh Jeff baa from um I work at a few School sites um what I'm going to be speaking on is what I've seen happen um at painter Elementary um I've noticed um when I've been trying to get a hold of the principal there um I call his office uh the phone line is no one's there um where is the principal well you look outside uh the portable he's running around chasing kids because he's had to um be out for all the recesses and all the lunches for all the kids um I asked him how long do you think you're spending um monitoring recess and lunch every day and he told me two and a half hours so arguably the most important person at painter Elementary is
026spending two and a half hours every day out in the hot sun uh supervising kids on the black top now to me that doesn't seem like a recipe for Success um at that elementary school I also um was surprised with the way they do breakfast at the school um when I started there this year uh the students are go after the bell rings to start school the students go into the cafeteria the kids wait they bring the breakfast back the kids eat the breakfast in class um that's losing valuable instructional time uh I don't know if there's anything that could be done about that but it just doesn't seem like a very efficient way to start the day um when the kids are freshest in the morning and should be learning that's all I have
027to to say thank you thank you our next speaker is Randa Barber Mr Barber you have two minutes please unmute yourself when you begin speaking the timer will begin good evening uh board trustees and Dr Bower uh first day of instruction on the 17th the I had the the Delight to see trustee Karina her Herrera loera and Dr B in the band room at Renaissance at fiser and it was one of those moments when everything seemed to be lined up and I had a a very interested young student that wanted to learn to play so we immediately started uh I I'm glad that you were able to see that because that that that shows the character of our students they're so happy to be back they're so happy to be doing things uh so that's
028a really really positive thing I encourage you to come to the campuses and see that you're going to see a lot lot of resilience uh I had another student play for me today I'm uh assessing their their skill levels and he said he played piano and most students say they play piano and they play chopsticks and it's all good and then we proceed from there he sat down and played some Mozart for me so it turns out he's a very very motivated young student who you're going to hear very soon um I say all this to offer some encouragement for everybody hang in there uh we we really need to hold on to our resilience and our commitment we all have it uh it's very very difficult times but I'm encouraging you to hang in
029there let's get our contract settled and kind of break the cycle of all all of those delays uh we really really want to get this done because everybody wants to be back accomplishing something and you see it most in the kids uh in our in my bands this week was the week when they just all started to pull together and it's really a delightful thing to experience even under these conditions so I encourage you to come out to the campuses and hear our groups and let's get our contracts settled thank you thank you Mr Barber our next speaker is Dinda mendosa miss mendosa you have two minutes please unmute yourself when you begin speaking the timer will begin good evening um board members and Dr Bower um I just want to voice what my colle
030are saying and please settle our mou and please settle our contract the sooner the better we can start moving forward thank you thank you Miss mendosa was that it Mr Tavis yes uh Madam president at this time we have no more public comment thank you so much uh on and at this time we'll go ahead and um I'll turn it over to Dr Bower for the special recognition of the teacher of the year thank you Madame President um it's it's it's emotional it's an emotional moment for me when we celebrate teachers and classified in anybody who's doing an amazing job in the middle of very hard times and I just W to um say that brief thank you for each and every one of the teachers that are going to be presented to you my
031my Miss Barbara Campbell tonight but I W to just make it very public that the the recognition the teachers are getting tonight it's quite uh unprecedented because these times are unprecedented and to be able to obtain that honor is quite an accomplishment I also want to say the same thing for the rest of the team the rest of the uh 500 teachers who come every day and are with our children today one of the honoraries told me Dr Bower the first two weeks were very challenging but now this week feels so good and I just feel the joy back to be back in the classroom with my students and those are the kinds of things that uh I appreciate apprciate and uh thank you for reminding us Mr Barber to hang in there because you're
032absolutely right we're going to go through this together so miss Campbell thank you very much uh for organizing this for us thank you if I could share my screen can let me do this so what I'd like to do is is kind of share can you see the picture and the the the list of teachers yes okay so each year the school uh schools in our district nominate an outstanding teacher for consideration of as teacher of the year and for 2020 2021 the school year was one of a kind due to covid each nominee stood out in their own unique way a committee reviewed the nominee ations and we had had had the difficult task of having to select only one to forward to the to the Santa Clara County Office of Ed this afternoon
033we had a a a petite celebration in the patio as you can see the picture there of the teachers that attended um for recognizing the ones that came today to our celebration we had a little ceremony giving them all their their PL and a little gift and uh shared a couple of moments and talked and got to know each other and right here on the side you can see the names of the people that um that were recognized for their schools so I'm going to read their names we had Vanessa Perez from Adelante dual Language Academy we had Veronica Marquez from Adelante dual Language Academy to Martin Brooks from H aptitude Community Academy at Goss Hector at at Chavez Elementary Karina Nichols from citan elementary Amalia Alvarez because they were all nominated at the end

035have in October and I know pretty sure that our nominee or our our representative ative Tamara bermudes who is a special day class teacher at Renaissance Academy teaching 67th and eth grade and I know she was going to be joining us tonight so if she is here uh I know she would like to say a few words marel could you see if she is here she's going to be moved over right now she's per to sleep perfect hello can you hear me now yes Tamara Oh I was freaking out because there was no mute button and I'm trying to like put a sign up saying there's no mute button well welcome thank you so much it is truly humbling and a great honor to represent Alam Rock School District um with the county um I
036have an amazing class of sixth seventh and eighth graders with autistic superpowers they are unbelievable and last year was a blessing in disguise and they became stewards of their own education they had long lists of Zoom calls you know Zoom uh addresses that they had to go to and I had it all set up in in Google classroom and they would be able to say hey Miss Bermudas it's 10 o'clock I got to go speech or hey Miss Bermudas it's 11 o' I got to do this and um it's not just about me um it's about them and all the hard work that they put into it yes I I I do whatever's best for my students and I found that if you do not love your students they will not learn from you um
037my parents were so happy because they were all independent I had no parents sitting by their kids um but it it is truly an honor and I'm I'm very humbled to accept this this great this great award and I appreciate the district and I appreciate the support uh at Renaissance at Fischer and the inclusion that my students have there they're not just at school they're part of the school so thank you board members thank you Dr Bower thank you Miss Campbell I appreciate everything you guys do and finally I just want to again if any of the other teachers are present thank you again for all your hard work and for you know stepping up and being there for our students and really going above and beyond that we know that you do every day
038so congratulations to all of you and um we're super proud of you thank you so much Barb um and at this time I'll go ahead and open it up to the trustees uh I see Mr fam's hand has been up for a while so I'll turn it over to him uh uh thank you madam president uh two things first uh I think we missed Miss Tanner uh she got cut off I think at during public comments I just wanted to let you know that you know we uh May we'll probably need to go back and give her her two minutes but uh the other part is first of all congratulations to miss Bermudez uh uh uh you know I had the pleasure of observing her class during the Lindale summer school and I tell you
039uh to teach uh the way you teach special education in uh In Summer with such ease it was a it was a uh example of what what good teaching can do so I uh congratulate you and I as you uh as we as you move on to the as a nominee to the county teacher of the year award I certainly hope you'll uh you'll hit a home run and uh show the county what Alan rock is made of uh also I want to take the opportunity to congratulate all all the other nominees from the from the school Vanessa Perez Veronica Marquez Martin Brooks Hector Hernandez Catalina nicholes Amalia Alvarez CA uh Kara Danielle let Forum Mo chandani kimy Hiroshima Christen meller Trang Lim Lynn Martinez Maria mooli M too Karen Rivas and Abby Harris h
040thank you very much for all you do for our children day in and day out and uh you know Alan Alan rock is better for having you in our schools thank you very much thank you so much trusty fam and I'll go ahead and turn it over to trusty Beano yes thank you I also want to congratulate everyone um you know it's already been said but having at any level um whether it's in the district office or students or parent parents but particularly teachers in the classroom we understand that this is a super difficult challenging constantly Dynamic environment that you're having to function and perform in and to know that there are many out there who are going above and beyond and those of you tonight that have been selected it just um you know
041it's impressive to know that that kind of work is going on something that we already knew um but it's good to hear and especially esally I just wanted to mention in the words that were spoken tonight by Miss Bermudas which I um give a a separate congratulations obviously and and good luck um in going to the next step but I think the two things that about what you said number one um I think you said something along the along the lines or to the effect of um students with autistic superpowers um and forgive me if I misquoted that but I think it was something along those lines and you said something also along the lines of it's not about me it's about them and I think with that kind of framework that kind of um
042philosophy behind your work it's no wonder to me that that you've received this recognition because just in those words in in the very brief um speech that you gave it's very evident to me how you in this difficult environment are framing the work that you do and obviously see the impact that it has on our students so um I want to again say I'm I was just impressed with those lines I'm impressed with everyone's work and I want to again extend congratulations to you all and thank you for the work that you do with our kids thank you trusty and uh do I see any other hands up I don't um I'll go ahead and add um just to add to what uh my peers have mentioned already just want to thank each and every
043teacher out there you know unfortunately we can't uh give these Awards to all the teachers uh but I know that you are all giving all that you have um and I see it and I hear it and you know my daughter comes home from school um so I I'm a mother and I see it in action and I want to thank each and every one of you um congratulations to all the teachers that were um on the list today and especially um to uh our teacher who will move on and hopefully um get the teacher of the year for the county um but in my eyes you know uh all of you that were uh named today uh had more than one person right more than me or more than any one of us saying
044you're doing a great job um you had your name submitted somebody um intentionally thought of the things that you are doing to show your leadership not just in your classroom but in your school um and each and every one of us right um we we our actions and our energy has has a ripple effect so I can tell that you are doing um that in a very positive way that's affecting others including um those that nominated you and uh put your name on this list and I just want to quote um Malala Y yfai which is one of my favorite quotes and I've used it before but I just want to reiterate it know one child one teacher one pen can change the world so thank you all for changing the world one child at
045a time um and I love love love the fact that our honory today use the word love um absolutely I think you know we must love what we do we must love going to work whatever that is and for you all it's going to you know your classroom and loving each and every one of your children with all that they bring um you know the things that make us grow sometimes you know it's that medicine that we feel you know I think about that you know and the work that I do sometimes it's like why why is this sometimes so hard and it's that area that is you know that helps you grow and so thank you for mentioning that and for loving each of your children um and I know they're your babies too
046when uh you're their teachers there in your classroom so thank you again um and with that I'm going to go ahead and uh hand it over to trusty kto I see your hand up trusty kto sorry about that I'm having issues with the unmute button I want to also join uh the rest of the board and the administration in uh thanking our teachers and uh congratulating those folks who went ahead and received the the the recognition they rightly deserve very much appreciate every every U teacher who's out there um going above and beond during these trying times um I'll share with you all that I we had a situation my son got sick and you know this is co so the slightest cough or a fever all of a sudden um begins to send alarm
047bells and so I just have to um thank the teachers who are going through through the situation with that with with the students that they have in their classrooms and um and so we we lived the situation luckily he was not um he was not exposed in his his uh test backs came uh came negative um that's not always the case and so thank you all for stepping up uh to teach our kids during these very very trying times um I for one hear your calls and I appreciate uh the the the calls to to go ahead and and come to some sort of conclusion I'm not trying to go negotia in public but I've always been pretty clear in terms of my position that we need to be Prov in uh proper remuneration um
048that we need to go ahead and be fair uh all the while we all we also have to maintain fiscal solvency for our district and so that's just the perspective of one uh board member so I do appreciate your comments and and um I've I I've publicly stated my position in the past so uh with with a thank you you should come the the support for our teachers to receive proper remuneration and the support they do while always taking into consideration that we need to maintain fisal solvency as well so thank you all for the great work thank you vice president GTO uh trusty Chavez I want to thank um all the teachers who didn't get nominated because a lot of times you know how much work you put into it and what's the most
049satisfactory to you probably is the fact that you know that you're making a difference in the kids' lives and I want to thank you all for that sometimes you don't get the recognition but that doesn't matter because the kids know that you're doing a good job and thank you very much and congratulations to the winner thank you I already went through the next item just kidding uh thank you so much so seeing no no more we'll go ahead and um move on to the next item so we're coming back to item 301 uh we'll go ahead and start off with Teamster I'm sorry Alam Rock administrators Association Jose can you um help us uh locate Madam president I did mention the the issue of Miss Tanner being missed in in public comment would it be
050advisable to you know give make sure that Miss Tanner has her two minutes before we move on to item 3.01 um let me uh double check in regards to um how much time did she speak no she did not speak and when you say she she got cut off you know in I guess she in the I guess she may have been uh she put had her hand up before we got to item 7.0 uh 7.01 so I think she got cut off so I just wanted to make sure she got her two minutes thank you trusty fam um I was unaware of that I know we waited a couple seconds um Mr Chavis if you can find her and um give her the ability we'll go ahead and give her her two minutes and
051I just want to remind our public that once we are done with um an item you know we're not going to be able to come back so make sure you keep your hand up and stay on um and you know once we're done with everybody that has raised their hand if you raise your hand up after that then we're unable to come back to you so I know sometimes you know we're doing a couple of other things and I get it um but if you can just keep your hand up you know and just be patient so that we make sure we call your name and I will um um continue to allow a few seconds for those of you who maybe are walking back to your computer to give you enough time to raise
052your hand so um do we have I think trusty fam said Miss Tanner maybe yes Madam President we have Miss Tanner Miss Tanner you have two minutes please unmute yourself when you begin speaking the timer will begin good evening Lord and superintendent um I did raise my hand while Addie vain was speaking so I did not put it in at the last minute it kept being lowered for me and I would raise it again I think I raised it seven times so thank you for giving me the opportunity I have two things I would like to speak on my behalf and then I have a letter from a colleague who's unable to be here um I I am I love I appreciate what was said by the G that is representing us for the county
053and I appreciate everything that all of these uh nominees have put in toward our district um the piece I love that she said is that if you don't love your kids they were not going to learn and we love our kids and another thing that she said and even Ernie I mean sorry Mr baharo said it's not about me it's about them and so that's where I in is is it really about them because we've collapsed classes I am my class is now over the limit I can't even walk around my room my students are fourth or fifth grade and they're performing at a first grade level is that really about them it's to take them from a class of maybe 24 and put them into 33 and 34 is that about them because it's
054not about me it's about them and I would love to be able to reach these students and with that I will now read this is now going to be another two minutes because this is from Kelsey Rothrock who is not able to be here tonight so I appreciate the extra two minutes for her and I'm reading her letter and it says good evening to the Board of Trustees and superintendent Bower I had planned to speak to the board directly tonight but due to a family matter I am unable to attend thank you to miss Tanner for sharing my concerns what started out as a potentially fabulous school year filled with collaboration potential and progress has quickly become a year of feeling defeated disrespected and unsupported within the first four days of school our team was
055told that a fourth grade class would be Clos and I would become a 4 five combo class due to lower enrollment in a year where where students have not been in school since March of 2019 the focus should be on smaller class sizes but instead I now have a combination class of 30 students the fourth grade class that didn't close has 32 students and the fifth grade class that didn't close has 33 students it is near impossible to social distance in our classrooms and I but I question if safety is really a concern I reached out to the board in the superintend immediately with my concerns only to hear that we have have to have teachers for independent studies classes and that we have other areas of need that we need to finance smaller classes
056are not part of those plans I do want to thank trusty fam and Dr Bower for responding to my emails I looked at the agenda for tonight in it you are going to approve 250,000 for silin learning after school tutoring and 250,000 to tutor work for after school tutoring 128,000 for a playground system why is that money not being put into class sizes we need to support our classrooms I'm really questioning this funding why isn't the priority for our students that are attending in person why at a time like this do we have only one psychologist for three schools this year doesn't feel like that at all it doesn't feel like we're doing what's best for students the morale of our school is very low and the teachers don't feel heard or respected thank you
057um and now I want to bring it back to um item 701 I appreciate Miss Tanner for coming back and also reminding me that I didn't open it up for public comment so um coming back to item uh the special recognition I'm going to open it up now for public comment um Jose can you help me uh with the public comment for the teacher recognition um teacher of the year and I apologize for moving past that so quickly uh yes Madam president at this time we have no uh public speakers with their hands raised okay we wait a couple of seconds do we now still none okay okay now we'll move on to item 301 alen Rock administrators Association I see a hand up so say uh if they're here for the last one that's

062now and you know for those of who don't know who don't know me I'm I'm one of the few that's left uh you know working here at alen Rock for the past 21 year I started my you know my job as a HVAC technician and you know since then I've been you know going and going and and you know is still going to support um all the needs that the district has I know we have infrastructure and Equipment that's that's age uh Beyond you know our our time but you know we're doing the best we can to support you get your equipment fixed make you comfortable in in your classroom so that you can teach teach the students so that they can learn and thrive from you know their education but I just want to
063you know assure you that you know Teamster we're here to support you and you know as far as you know cleaning maintaining uh feeding the students we're we're we're here you know from day one since you know covid started Teamster has been uh on that on that boat you know uh chugging along and and supporting you know whatever ever needs the district had uh and and ongoing anyway I'd like to also uh thank Madame President for acknowledging um the members of the military from our country uh in protection of a great country right now um I myself if if you don't know I'm a 2022 years veteran of the Armed Forces myself so I'm very passionate when it comes to Military and the recognition that that you acknowledge um you know I I love this
064country and I love what I do and I serve you know my my job is basically you know serve the community the the country you know whatever I do it's it's just just a you know it's what I do and what I love to do uh on that on behalf of that uh you know I'd like to welcome all the teachers back and you know it's good to see see you back and I like the fact that I I like to go out and visit you because you you know not not because of the issue that you have there but you know to assure you that we we're here to to to you know we're in the same boat to to continue our uh the education for the students and you know you know make
065the best of of this um this time during this time and it's uh it's very U you know satisfying when when you uh can can do your job and do it a good job at it you know I'd like to thank the teacher for doing that and stay with the you know stay with it we need to be resilience and just um you know move forward these kids the students needs us and at this time more than ever so that's that's what I wanted to tell the um you know the board and and the rest of the teacher staff students community members uh we're here for you guys thank you very much thank you Mr Fu uh now I'd like to open it up to California school employees Association Madame President Miss Sharon fontain sends
066her greeting she not able to join us tonight okay thank you uh uh next we'll go to Alam Rock Educators Association we have Joselyn or somebody here in her place good evening can you hear me yes welcome the opening line for everyone um I too would like to congratulate all of the teachers who were selected to represent their school sites as Teacher of the Year this year and a special acknowledgement to Tamara Bermudez who was chosen to represent alamro at the county level I have had the honor and the pleasure of working with many of these teachers in different comp capacities whether it was as uh colleagues on my own staff or through area and know that we do have a remarkable group of teachers and uh they're all special they're all teachers of the
067Year especially for last year anybody that made it through last year and is still with us is deserves honor so um moving on I know that you've heard from many of the teachers or some of the teachers anyway that have um joined us tonight uh it's kind of interesting in that I when I sat down today to write some of the what I wanted to touch on I had no idea that basically I would be touching on almost everything that you've already heard but I I'm going to share with you you may not want to hear what I'm about to share with you but if you sincerely have the best interests of our students and staff in this District at heart I urge you to listen with a solution oriented mind set aside any excuses
068or blame and take seriously the concerns that I'm about to share with you because they are genuine they are not simply complaints for the sake of complaining trust me the teachers in our district don't have time for that the majority of us just want to do our job in a safe environment we want clear consistent protocols to be followed across the district to protect the health of our students our families and ourselves this is just not happening by overcrowding classrooms above the maximum class size with no consideration for mainstreaming of specialed students is an issue why splitting up students and adding them to already overcrowded classes because there's no subs to cover classes is an issue by not providing prep periods to those who have it um afforded to them under our bargaining agreement because
069staff needs to be pulled to cover in other places that's an issue by not sending students home from school who are clearly sick is an issue and I don't just mean a slight cough I mean students that are running fevers and have coughs and have covid symptoms while they may not have covid they are experiencing multiple symptoms and they are being sent back to classes by piling on more work for teachers to do whether it's assigning them to more committees or requiring detailed lesson plans is not just an issue it's ridiculous this year by Under reporting close contct covid cases for fear that the word will get out is not just an issue it contributes to the spread of this pandemic by running out of basic PPE I'm talking masks and hand sanitizers is a
070safety issue and the list goes on and on I ask that you acknowledge these issues validate the concerns even if that means that you must go out to the school sites and talk to the teachers who are living this and then let's work together to come up with some workable Solutions I know you have received many emails from Individual teachers because I've been copied on some of those emails trust that it takes a lot for teachers to take what little time they have in their day to reach out to you but the general feeling across the district from area members right now is one of desperation and defeat I honestly have not felt the morale this low in many years and from what I understand it's not just among the teachers who are feeling unsupported
071and flailing right now we have only been in school for 17 days and we already have five teachers who have quit we have more that have asked to we have more that are waiting until their positions can be filled so they can leave two of those those were brand new newly hired teachers we understand that there's a shortage of teachers in California but there are still steps that can be taken so that we don't scare away the ones that we have here and we have good quality teachers dedicated sacrificing their health and safety every day there are certainly things that we can do to improve on the appeal to attract teachers to come to alumrock but we just aren't doing so sure the sub pay was raised and I truly appreciate that that was great
072and when there was no water that was um reaching the school sites during those first few very hot days changes were made that were that allowed for Direct Delivery to the school sites two days a week I've now been sent pictures of the water supply and and how excited everyone is that it's available everyone is grateful for those changes that have been made but we need more actions taken like that that not only increases pay but improves our working conditions not all actions cost money even though we certainly shouldn't be short of funds with a 5.07% cost of living adjustment coming in and an additional $56 million from the state of California that's more than onethird of our operating budget most of what the teachers are asking for in addition to basic materials and PPE
073that again appears to be in short supply is to know that their safety is a high priority however instead they are hearing excuses uses and receiving blame you expect us and we expect ourselves to have high regard for our students we are respectfully asking for you to have that same high regard for our safety and our working conditions sometimes it may mean taking a stand in exceeding the minimum allowable recommended guidelines set by the county or the state health Department to better protect the students and staff in alok ARA acknowledges that this is a difficult time with unique constantly shifting challenges we also believe that if the District administration and you the our Board of Trustees listen and carefully consider what we have to offer there will be an opportunity to make noticeable improvements to
074working conditions that teachers can find comfort in please stop telling us what can't be done or what you're choosing not to do and start taking actions that show us that you have our backs thank you thank you uh next we'll go to uh super thank you Madame President um there's a lot of things going on in my mind in terms of um how this year started and it certainly was not um something that we imagined a year ago like year ago we were also opening in a very different situation and we heard some very similar concerns in in in terms of support um but nobody has had a playbook in terms of covid and it's been one of those situations where the only way that we can uh move forward is to be able to
075to listen to each other and to work through things through these very difficult things together I want to uh comment specifically on on a couple of items so that not only our staff but also our stakeholders are very are uh will be clarified in terms of the way we send notices for covid because these the those um guidelines are not prescribed by the district and I have no authority of changing them or twisting them or or having a different protocol those come from the public health department and they are the Authority for us to go to in terms of how do we respond when there is a positive case in our sites or there's closed contact so that is the reason that there are multiple notices um there are two main kinds of notices one
076is a general notice to the staff when there is a case and there's another notice that is more specific to close contacts all of those Protocols are given to us by the public health department and our nurse staff have been through Heroes through all of this because they are the ones helping us making to make those determinations of who gets which kind of note and so the moment that we receive that HR sends the general note to the site and if uh staff is paying attention there are multiple notices sometimes that goes within one day so I cannot understand how that is concerning but all of those go back to the dashboard that is readily and publicly available to anybody who wants to know and see the close contact notice goes to specific individuals that
077the nurses and the county deem to be appropriate our nurses don't make those decisions by themselves they also connect with the the county uh Public Health Department to make those determinations that also includes when somebody sends a child to the office with symptoms because we take those very seriously right now the people that are making the decisions of sending students home have been the nurses I have also issued reminders to parents to be to are on the side of caution and to keep their students at home if they have any of those symptoms and um it's a reminder but we cannot prevent our students from being uh in school and so I just wanted to make sure that um these are the kinds of notices that are going out and the those notices in the
078staff in the generic staff notice it says the number of uh cases per the site so that is the way we are keeping all of our staff informed about this these cases and we place those numbers in the dashboard so we are able to do to communicate with our stakeholders in terms of those numbers the second thing that I wanted to mention is that um under these circumstances the whenever a student is sent home to be quarantined or stays home to be quarantined their education needs to continue and this does not mean that they go into Independence studies because that's a different uh legislation that we were imposed again Alam Rock didn't pick this this is something that we have to implement so if a student goes for in every case that's the other main
079thing every case is different I cannot say none of us can say if this happens then this is the way we're going to do forever because we're dealing with specific cases with specific Health situations that are different from each other that's what makes this very difficult students have a right to continue their education and so teachers will be preparing and are preparing already because we have already some of those cases packets of Education of of the homework and the things that students need to continue in while they are in quarantine um lastly I know that I have not been able to um have a you know a a comment on all of the issues that were presented but I'm certainly listening to them and I want to thank to all the staff members and the
080teachers specifically who have sent me directly their questions their concerns I appreciate that you come directly I do also appreciate apprciate a couple of the comments around supporting principles I totally Echo that it has been a very difficult time for them um not so long ago uh we had to go into major savings mode and we are still as a district trying to navigate through that and just to remind everybody on the May meeting CA gave a detailed present presentation regarding how the covid monies were going to be spent so if anybody has any more questions about that please go back to that presentation is online every anybody who has any questions about how alumrock has spent those funds please refer to that presentation because that's what it is I will I've been checking with
081sta regarding the the concerns about the PPE because that is something that we are very concerned about and it would be very helpful if we get the specific sites sometimes when we say we're missing PPE and if I don't have the site it's very difficult for me to to follow up but I also want to shout out to Mr Ed yel who has done above and beyond the Call of Duty and all OT making sure that our schools are taking care of so very difficult times very difficult times excuse me but at the same time um we need to survive them together and that's why when Mr Barber said that I really appreciated that um and it is my allergies what you're hearing in my voice so I apologize for that um but I know
082that together we're going to move forward these times are not easy the only way we can survive them is to have flexibility and I know that's not something that people want to hear but because our own guidelines are constantly shifting from August 3rd to today we have received three different decision trees from the county so if you think it's confusing um it is also confusing for us sometimes and we just have to re Reet and move forward we have I have no choice but to follow those guidelines those are the protocols so thank you everybody I Echo the frustration I Echo the anxiety I understand that completely I wish I had a magic one I wish I could in one word or in one sentence be able to make everything right um but I can't
083all I can tell you is that we're trying our best and um um knowing that each and every one of you the 1,140 staff members and multitude of stakeholders care deeply about this community and the only way that we're going to move forward is if every single one of us gets a vaccine when it's appropriate that's the only way to erase covid from our Mist thank you guys thank you Dr Bower um and at this time I'm going to open it up to my peers any trustees who would like to say something trusty Viano yes thank you uh Madame President um so first of all I W to just take a step back and I actually want to thank uh Mr Tom Fu and for his words um in his section of our updates here
084and you know I really appreciate that spirit that I think very clearly has been ex exemplified by you know Mr Fu and his Teamsters all the you know our employees who are providing all of those services and that is also exemplified in other areas of the district as well that Spirit of you know it's we've referred to it of resilience of you know pushing forward and trying to um you know make sure that the children that the students are are at the Forefront of what we're trying to do here so so I I am always you know appreciative of those efforts by by teamsters and I'm really appreciative of of um those comments tonight and also thank you for your service I wasn't actually aware of that your personal history so thank you very much
085for that um I also want to thank Dr Bower for um for your comments tonight I know we keep saying and it sounds like it's I don't know I feel like it sounds like it's just something to say at this time that these are difficult times challenging times unprecedented times at some point those just become words kind of but it is the reality and it's it's hard to come to grips when maybe you're you're at the front lines and you're on you know doing that work to hear those words that oh this is just challenging times and these are you know may sound like excuses and I speak from my own personal experience as as an employee of a large organization that you know brings its risk with it and I contracted covid um you
086know back in December and and you know I understand how you have an organization saying all the protocols are in place and things are changing and it's Dynamic but yet you're in that office you're in that classroom wherever it may be and you're putting yourself at risk and some of us you know have been exposed and had covid and have these you know long-term effects and all of those things so I get that and I appreciate um hearing those things in emails and and hearing the the very raw concerns and and um thoughts of our staff and I I personally take um the approach I I don't typically respond to each and everyone because for me it's important that a single um me message gets out there and I don't want you know for a
087person to send an send a question or a statement and then have five different answers and and add to the confusion that they may already feel so I know Dr Boward does an excellent job of responding to those at least to my knowledge and so um you know when I do have concerns or questions I do bring those up and I know all of us has trustees bring those up you know whether it's in close session or individually or whatever it may be um but I do thank Dr Bower for for taking a moment to kind of respond to the reality from her perspective of of what this looks like um and I think finally one thing that you know is important to me is um at the end of the day we we have
088customers or clients or or you know those that we serve whatever you want to call them and that that's our students that's our families that's our community and for all of us I think um that word trust um you know trust in what we're doing and all of everything that goes along with that is very important and so you know whether it comes from the perspective of being um transparent about our finances and and our budget which Dr Bower alluded to in her comments um whether it's about covid related issues whatever it is I think that our families in these very difficult times need to have you know feel trust and so tonight we have on up for approval um uh another contract with a panorama I believe is the the company that we use
089to do a lot of our um surveys and and to get a sense of different per different perspectives of the district and how we're performing and I can only well not only but that type of data is a lot of what I go by in trying to assess that trust level from families and students it's not the only thing if when I received emails from we received some emails this past week from um parents and community members um that's also uh you know something that we take seriously but it's also the data and so um you know I just want to be make sure that the message that gets out to the community yes there's different very difficult and challenging times we're trying to address them as they come and adapt in the moment but
090also I'm encouraged by the fact that at least the most recent data um that our Panorama surveys got to us was that there is a large like 95 to 98% I don't remember exactly but our parents and our community has a high level of trust in you know their children being safe in schools the work that's being done that that's that was proven out at least from the data perspective in our last Panorama surveys that we had so you know I look forward to you know that item tonight because I think that's data Maybe in the next one we do see something different if people are saying that there's no trust in the community or it's diminishing then I would expect to see that reflected in that data but at this point all I have
091to go on da from the data perspective is what we have most current and that is a high level of trust from our community and I think that's important that the community trusts the work that's going on and and they know that it's not perfect in our own personal lives we know that every situation isn't perfect whether it's you know whatever it may be but um I just kind of wanted to get that out there that I get that there are things that we can always improve on but they're also in my opinion based on some objective information is a high level of trust in the work that we're doing that also includes Audits and you know all the things that we've gone through the past few years that also bear out this consistent um
092ver validation of the work that's being done and the trust that the community can have in the work that we're doing so with that being said um I will again just thank everyone top to bottom bottom to top and all over the district for every thing that you're doing and we will continue to be with you here um to get through this and move forward as a district so thank you thank you so much trusty Bano uh trusty fam yes thank you madam president well first of all uh you know being that Saturday is September 11 and it's marks the 20th year of that I wanted to first uh take this moment to uh pay on pay respects to those who lost their lives and as well as those who uh put their lives on
093the line uh in Ser uh in service and I reference uh our very own Tom po who is a a veteran so I wanted to make ensure that we honor those who serve and especially uh those of our Alam Rock School District who have served in the military uh thank you thank you very much uh just a few things uh uh I wanted to give a quick update about uh the disposal of surplus School properties I'm happy to say that uh at the August 19th meeting when members of many school districts came to that public meeting and voiced their opposition I'm happy to say that uh the city of San Jose has for the time being uh decided not to move forward with proposal that they put forth in March but um I wanted to
094still stress the importance that our district as well as many of the school districts that I wrote to in the course of uh making uh our fellow school districts aware is that uh the city still continues to plan towards making roles regarding the regulating our ability to manage our our school properties and um that's something that we must still remain Vigilant and I'm proud of the fact that this board has passed uh a resolution that I proposed opposing that City policy and authorizing this District to take necessary action uh to oppose uh that unjust City regulation so you know for the time being we've we may have round one round one but we've got to keep working at it for round two and Beyond um I also want to thank um this has been a
095tough tough school year if I were a screenwriter for the X Files and I wrote about this i' probably be I would probably have been fired because no one would believe me but uh as they say truth is strangered in fiction so I uh all the members of teamsters all members of uh CSEA all our teachers all our un non-represented staff and administrators thank you for uh making this school year work as best as it can possibly can in perhaps the most challenging circumstances since the Great Depression and I also want to make some make sure that uh I I especially thank all the teachers who uh though may not have been nominated for Teacher the year uh this District would not work without you all so I uh want to thank you from the
096bottom of my heart uh for all your service lastly uh on a hope upbeat note uh uh there is the Moon Festival Saturday September 18th our very own uh Vietnamese dual language Emer at the painter uh will be taking part in the parade so I hope that uh you know I will I certainly uh will be here to support support our kids I hope that you know where where we can we all turn out to uh support Alam Rock kids as they March forth in the community and you know make us proud um you know and on that note Madam president thank you very much thank you trusty fam any other trustees I would like to say anything before we move on I'll call you uh trusty Chavez would you like to say anything before
097we move on no you can move on okay so no no report from you I just want to make sure I give you an uh vice president PTO a chance to speak okay so I'll take that as no report uh vice president kto uh thank you madam president um I uh I want to thank those folks who came out and spoke uh for you know there was a variety of issues that were raised and I think it's important that uh individuals be recognized I know that it's difficult to come out and speak um you know you have a lot of stuff going on and um you do take your time and so I I just want to acknowledge you and appreciate your you coming out and letting us know what's going on I think that's
098information that is very very important and uh and if if need be then if you find that this is the only venue through which you can go ahead and be heard then then then by all means um I would hope that you felt you would feel safe being able to go to your sites supervisors and then you and Avail and use those channels but um I will take the information however we can I think it is important that we be informed things like um the lack of PPE uh as has been mentioned by the administration there there there may be reasons why that might be why might why why that might be the case and so we want to get to the bottom of that I personally want to know what's going on and so
099I intend to to ask uh for a response to that in particular so um thank you very much for that information you gave us with regard to Mr Barber's uh comments about music I think that's important that you brought that forward uh because it really highlights that Alam rock is going above and beyond uh we have neighboring districts who have said no to uh things like Arts the music music program Sports um we have obviously our competitors who simply go ahead and teach the test and um and focus on the Bare Bones education that they provide provide uh the the their their students and we don't do that here at alark and I intend to make sure that we continue to go ahead and invest in that comprehensive education that um every child deserves um
100and uh and so thank you very much for highlighting that uh area of um of elmrock that I think differentiates us from many other places whether it's our our award-winning Jazz program aiai program uh everything else that alamro invests heavily to go ahead and continue to support the community invests in is very very invested making sure that continues I want to make sure that we continue to highlight those things that differentiate us from our competitors both public uh school districts that surround us as well as uh our um publicly funded but privately operated competitors that are operate within outside of our district uh with regard to uh 911 I also want to take the moment to acknowledge the significance of of that date um my just was speaking to my students actually that brings to
101mind that I I also have gone back in person um to teach and so it's uh I'm very very excited also you know there's there there is the concerns that are shared by all those of us who are out there in large groups and in closed settings and so I share the concerns that are that have been raised so I do appreciate that um but yes uh we were discussing that that that most uh difficult event and it's it's you know I see the passage of time and how when I started teaching the students were actually very young and now they weren't even alive when it actually happened and and just know it as a memory and so it's important to share with those who um weren't there to to live it uh the experience
102so that the memory of those folks uh uh um isn't forgotten and that we can go ahead and um and uh pay respect to those individuals those uh individuals who were the lives that were lost that um thank you very much Mr President whoops okay thank you vice president kto and we'll move on um I'll go ahead and uh give my and uh and move on to the next item man tough times definitely tough tough tough times for everyone you know I I hear you teachers you know I um I too have gone back to classroom and started teaching a class at San Jose State University um and I think of my safety and my health you know all every time I'm walking into that class as well um so I can't imagine I can't
103imagine being in your shoes um and you know the more I think of leadership um you know I can't help but to think of some quotes that I kind of you know have have lived by you know one of them that comes to mind is a leader is someone who demonstrates what's possible and I also think of the leaders that were in these positions you know in positions like yours during the time of leprosy during the time of uh polio um you know our Humanity has gone through these things over and over and we pulled through right some of us didn't make it just like through covid unfortunately some of our family members or community members are not here anymore um and it's very real and it's very scary especially for those of us who
104have lost people and are continuing to lose people that you know are from our community I received a couple messages about you know a couple who have lost couple of people who have have lost their lives this past weekend in their early 20s because they didn't get the vaccine for one reason or another and so it's very real you know it's it's not I mean it's it's something we're dealing with on the um everyday basis and I get it you know when there's a positive and um you know if it's in your space if it's in your community you know the feelings that that can bring um so yes I'm with uh you know Vice president GTO when I hear that there's you know no PPE you know we need to know those things absolutely
105and know that um all the messages that we receive you know and uh there's one of me and you know working full-time at the emergency Operation Center and everything else that we get to do um is really impossible obviously for each and every one of us to respond to every uh every message um and those that can great you know but I ensure that I follow up with Dr Bower um and thank you Dr bow for responding to you know those messages and everything else that's on your to-do list um to ensure that our teachers have what they need in order to do their job um we also know that some didn't come back some didn't come back to the classrooms some didn't come back to their jobs and that's okay you know not all
106of us you know we're okay with going back to whatever that job was for us after this pandemic we each have our reality and there's no judgment right um and we know that those of us that have stayed and that decided to go back to the office back to the classrooms back to whatever that means um you know it's a little bit more of that like we we're showing up we're showing up and we're showing up that it's POS we're showing that it's possible I'm thinking of you know the leaders right I'm thinking of the uh Governor at this time who might lose his see because some people were not in agreement with some of the decisions he made which by the way make sure you vote if you haven't yet I'm thinking of you
107know um all of those that did everything they could and they still you know um lost family members community members um I'm thinking of the staff and teachers who are coming every day doing all they can and are still feeling helpless or disillusioned the morale I agree you know it's low for all of us I think at this time and we're all kind of doing our best as we're moving forward but know that you're not alone and you know we're here to support and um you know I'm thinking of the parents who have no choice but to send their kids to school when they want to keep them at home and be able to teach them from home and support them you know with a device and all that that takes but there's parents that
108don't have that luxury or that choice and our community members again also doing their best um to inform our communities and and keep keep keep us together you know moving towards and getting past this I think that it's almost like the tell end of that Marathon right it's the hardest time it's like H you know I might just like give up but you know let's let's work through it let's get through it and once we're past through this you know all that we'll be able to look back and just be able be able to breathe and continue to move forward and I want to also um remind each and every one of us of our children of those that are not even 12 right yet that can't even get the vaccine that hear these things
109that maybe you know hear conversations whether it's from their parents adults in their lives maybe a teacher on the phone or uh you know maybe somebody in their classroom has covid and they don't know who it is and the way it's being talked about you know some of these children like they have no choice or voice really you know they they're gonna go to school their parents says what they do their teachers they got to listen and follow directions so think of the those you know things and and our children who are depending on us uh the adults around them um and know that I will continue to do my part and um I agree you know with a lot of the comments that were made and Sandra Rivera again I apologize because I mistakenly
110hit uh you know a different button and then I communicated with her but Sandra Rivera's comment about that chain of communication communication is key so I agree with her you know ensuring that the communication stays consistent unfortunately at this time based or fortunately on what the Santa Clara County directs us to do even though some people might not like that or they think that somebody else should do it but we got to follow those guidelines and those change sometimes day to day week to week and we're doing one thing and it might shift again so thank you all for understanding um and also in regards to the chain of commands just reminding folks you know and I'm in agreement with vice president in you know ensuring that you go to your supervisors you know ensuring
111that you get what you need and if you're not you know Dr Bower is there and if she's not doing what she needs then we're here so we're always open right for emails and phone calls and my numbers public and my emails public and I encourage you again to go through the chain of command as well through your supervisors through your principles and if that doesn't work through the superintendent and you know if that's not working absolutely absolutely we're here um to ensure that you have what you need in order to continue to do your job safely um and as happy as we can at these times um and with that I'm going to go ahead and move on to item 401 public hearing on Gan limit calculations opening up the public hearing at this
112time uh do we call for public comment Dr bow no no because the hearing is the public comment yes thank you so much all right all right moving on to item 402 public hearing regarding sufficiency of instructional materials opening up the public hearing at this time all right moving on to 501 approval out of state for Global youth Justice Boston Massachusetts September 28th through the 29th for member Madam president I I believe we appr we agreed to uh consider item 5.02 first I'm sorry yes I did have that thank you trusty fam uh yes so let's uh bring up uh 502 approval of resolution number uh 11222 board member vaccinations and meeting conict thank you trusty fam and I'll go ahead and turn it over to you since this was an item that you uh
113first introduced yes uh Madame President you know in in light of the expiration of the governor's order allowing us to uh meet uh virtually on September 30th uh given that we are the the governing board of the district and uh as such we have a responsibility to protect the health and safety of all all those who attend alen rock and all those who serve Outlaw uh I you know uh I brought for this uh or this this item uh basically as as a means of this board protecting not just uh its health and well-being but protect health and well-being of others uh I think as as the superintendent has said the the only way out of this pandemic is vaccinations and uh for this vaccination is free uh and I am given that there that
114this has an ample exemption for those who are medically unable to take the vaccine they must uh they must submit proof of a negative test in the event that they are unable to be vaccinated uh I urge my colleagues to vote Yes on this proposal thank you very much thank you trusty f is that a motion uh yes yes Mo motion to approve on second second by vice president GTO and do you have something to add to that vice president GTO uh no no I was just I I Concur and I agree just one and a second thank you um any other trustees Chavez uh uh trust yes thank um first of all are we um well I guess my comments don't really have too much to do with public comment necessarily so I'm okay
115I guess what I have two things that I wanted to say number one um I'm kind of actually at a little bit of a on the fence on this one for a couple for one particular reason um but I do support um everything that's in this um this document as it regards to vaccinations and and the considerations made if you are not vaccinated and all of those things however I'm I've trying to connect the last paragraph um or close to the last paragraph be a further resolve that um the reaffirmation of um our commitment to the to our uh code of conduct the reason why I I you know that may impact my support of this this um this resolution is that I I don't I under the assumption and I am under the belief
116that we are all operating under the um the expectations of our code of conduct and for for us to have to reaffirm it to me suggests that we are not actually doing that and so unless there is some significant reason that I haven't identified or maybe a connection to the rest of this document um it's hard hard for me to to to support the first part if that part is in there so I'm I guess partially it's a statement partially it's a question maybe I'm missing something about the connection between the vaccination part above and the um reaffirmation of the code of conduct but at this point I'm kind of on the fence um due to that particular part at the end so that's my those are my comments for now thank you trusty Beano
117trusty Chavez I actually agree with what uh trusty Beano says I will be voting no on this thank you any other comments questions yes Madam president uh board member fam given the fact my my interest um was yeah the affirmation of the code of conduct is fine because it's already there we should be abiding by it but my interest was to meet maintain the health and safety of our community of those that may coming to inperson meetings as well as fillow board members and so would you be willing to scratch off that section uh and then keep the rest so that this may be able to move forward yeah maybe that's what trusty Chavez is also concerned about the code of conduct that nmg may be able to vote for it yeah uh Madame President
118well I mean uh you know part of part of the discussion when this was brought forth was I believe Madam uh President also uh uh mentioned the issue of of board Behavior but uh I think that the issue of health and safety is a lot more pressing at the moment so I am uh of course I you know uh amend so amending the motion to approve everything but the last section of the um of the proposed resolution in regards to uh board conduct I have a second or concur uh thank you I I did get um those details and I will speak on it because I did add that piece um so I just feel they need to speak on it whether you know obviously it's it won't be won't be in there and regardless
119I um do see to put it back if if we get more support so I mean and I'll just speak to you know the reason that I put it on there regardless right like trusty Viano mentioned we should be following it um and you know I I felt the need that some of us needed a reminder um but that will be and and being that this was brought on as board member vaccinations and board meeting conduct uh I talked to roio about including this piece um and he you know suggested to including that specific part um and I do want to you know read it out loud just as a reminder like you said trust Gano we should all be following it anyways so be it further resolve that not not withstanding the challenges and
120stress stresses posed by the pandemic the Board of Trustees and individual trustees are reminded of and reaffirm their commitment to conduct themselves at board meetings during these stressful times in accordance with the board's code of conduct board bylaw 9006 including but not limited to conducting them themselves lawfully with integrity and high ethical standards in order to model the behaviors expected of staff and students and to build public confidence and credibility making every reasonable effort to protect the integrity and promote the positive image of the district and one another never embarrassing each other or the district and demonstrating respect for the public as a whole and community members individually at all times in all situations so I didn't see that as a problem as to any one of us agreeing with that um you know and
121that's fine you know we don't have to have it in there um we get to follow it anyways um and you know again I I I brought a quote that to me you know spoke in this situation so leadership is an active living process it is rooted in character forged by experience and communicated by example by John S Salon um and this is what it is right we are the example as you mentioned trusty fam you know we get to be that those those leaders that you know not just come and say get your uh vaccine be healthy wear your masks but we get to do it right we get to be the example I know other districts started from you know demanding staff or having the students you know get these vaccines but I
122don't know so much the the trustees right and so I appreciate the fact that we're starting with ourselves and asking ourselves of ourselves to get the vaccine first when and if we decide to go that way or if the you know state says we must all get them I think it's always good to start um with with with ourselves so I'm going to be you know supporting this either way um but I wanted to make sure that I added that piece as to I felt it was important to um add that in there uh being that it was a resolution again um titled board member vaccines and board meeting conduct um it was important for me to highlight things about the conduct um otherwise just vaccines wasn't enough for me um in that but I'll
123still support it anyways trusty fam yes and I'll say this you know in in plain language who the vaccines save lives uh we know that those who didn't take the vaccine are at greater risk of uh disease and death the the numbers don't lie uh I think I can uh you know as as many Health authorities I said it it it is becoming a pandemic of the unvaccinated and uh uh I I just can't think of a fur you this is the strongest perhaps the strongest possible statement this board can make in regards of promoting the health and safety of of those we serve and those who serve us uh you know we if we're tasked as as a collective body to uh steer this District uh we should we should not only protect our
124you know this is not only this is a you know this is both good for ourselves and good for others uh I would hate you know uh seeing the devastation of those who uh of the victims of Co and our community uh if this is perhaps the most not just coste effective but the only uh available effective way for us to bring this pandemic to an end however it may be uh you know this is a matter of health and safety this is a matter in many cases life and death uh I and as I said um you know and I I you know have originally as I said I wanted you know the the item was just to specifically concentrate on the vaccine portion so hopefully now that the the motion has been amended
125to leave out the uh the final paragraph Regard in relation to foreign conduct uh this is the closest thing to a gimme that that has ever existed here I mean uh you know you know at some point we've got to take responsibility for not you know not just ourselves and but also for others and uh H this is the OWN this is the only Avenue for that so I you know for those on defense ense I uh unless uh I am open to hearing Alternatives and again there's all there's an exemption for those who are medically unable to get the vaccine so uh I again urge my colleagues to support this and uh I am if there's an alternative please please say it now thank you very much thank you trust I do see trusty
126and vice president hand up uh after vice president kto I'll go ahead and call for public comment trusty Bano okay yeah thank you um one first of all one thing that I well I'll start with this I want to um thank trusty fam and trusty kto for um being open to modify uh their motion and and second and with that modification if that is indeed how we move forth then I 100% will be supporting this um if uh you know I agree with everything trusty fan just said I think it's important and for a number of different reasons that I won't Echo that he already said um but I just want to reiterate with regards to the behavior part it's not that I disagree I think obviously with the code of conduct and how we
127should um comport ourselves I think for me personally it's just um that having to include it when it already exists to me suggests that there is some significant issue on the board and having you know sat here with most of us for the past three years I I don't think that that is the case I mean I think sometimes people get passionate and and we can talk to those people individually but for me to include it in here suggest publicly that um something a little different so that's that was my rationale but I agree wholeheartedly with the with the spirit um behind it the other last thing I wanted to say that I forgot is is um in the the part the vaccination part it kind of refers very generically to to vaccines um you
128know just in general board member vaccinations and I I wonder and I throw this out as a question if we should just be a little more specific with regards to this resolution to say covid-19 vaccinations or whatever just because you know there are vaccinations out there for any number of different things um and so I I for me I think I like to be a little more um specific or clear that this is and it does mention it later on in um the document but I think just upfront when we're just talking it just says vaccinations um I I wonder if we it would be even more significant if we highlighted that we're specifically talking about covid-19 vaccination so that's I forgot to say that I apologize on my previous comment thank you uh is
129that an amendment or should we amend it at this time to spam any yeah I'm that's that's fine if it wants to say resolution number 11- 2122 board member Co vaccinations so be it so uh uh I yes I accept the amendment thank you thank you trusty fan andto do you set the as a second with the amendment um I think that the resolution as a whole um has to be taken is taken as a whole so um given the fact that it's mentioned afterwards it doesn't necess doesn't necessarily need to go ahead and include that but in the spirit of compromise I'm willing to go ahead and take it but I would hope that we can move along and and accept it as is at this point and then I know you had your
130hand up for any additional comments or thoughts uh yes so um I know that uh some of our colleagues said that they had the same concern as uh as a board member of Bano and so I hope that this allows us to to have a unanimous vote that supports this uh moving forward I think that um it's important for us to model the things that we as a board are are um encouraging or or pushing out there um we have throughout the state of California you can't go into a u teach if you don't have a TB test in place and I know that's different than than a vaccine but nevertheless kids can't uh go and get a public education if in fact they haven't shown their uh updated vaccinations um and that that that
131was a result of the whole issues around um the measles in in Disneyland remember the outbreak and so there's there's precedent already in place that says that public health is a big deal and that uh we need to go ahead and take it seriously and uh we can limit the inclusion of certain people if in fact they're choosing to not um move forward and and take into consideration the health of the entire group and so it's under that um it's under that's the frame of thought that I'm using as I'm going forward and supporting this and so thank you uh board member fam for your uh introduction of this policy I think it's important and I think it's in line with what we're seeing uh take a look at all federal workers now are required
132to be vaccinated and there's no options for um testing and stuff of that sort we saw La UniFi just got announced that everybody above the age of 12 needs to be vaccinated so it's not like we're outliers um we we actually are taking it step by step and here starting with the board to set the example so thank you to my colleagues who are going to be supporting this much appreciate thank you vice president GTO and I did mention we would go to public comment but I do see trusty Chavez's hand go ahead trusty Chavez uh can we just bring it back next month with the covid-19 on it and the other one uh deleting the other part um another reason why it might be is after September 14th should there be a new governor
133they might there might be new mandates we don't know that's all thank you thank you was that a question to anybody in particular or just in general I see trusty fam your hands up you know I I'll answer that uh look this is a board specific specific to us mandate uh uh you know I acknowledge that possibility on after September the 14th but at the same time uh you know the if my understanding of current you know current legislation is is correct uh the board as a body still retains the right to regulate uh uh to regulate actions for the health and safety of the board as well as uh the the to protect the health and safety of others as the board interacts with others uh so I certainly hope that answers the question
134uh again I uh you know the vaccines protect both you and me and everyone else so so I mean I just can't think of uh you know the uh you know if if you have a better way of protecting the health and safety uh of us and others uh I'm all ears but right now I mean you can take Dr pouch's word for it you can take Dr K's word for it it's uh it's the best weapon available against Co thank you trusty fam at this time I'm going to go ahead and open it up for public comment uh Jose Chavez can you um help us with public comment if there's anybody from the audience or the public wishing to address the board on this item yes Madam president at this time uh there is
135no raised hands uh we have one we have Miss Veronica Pelton Miss Helton you have two minutes please unmute yourself when you begin speaking the timer will [Music] begin good evening board president superintendent bow and Board of Trustees I just wanted to uh briefly comment I know there's been a lot of discussion and I was unable to um hear the beginning of the meeting but I just want wanted to say with regard to vaccines I've seen uh over the course of the time that we've been in this pandemic that there's been a lot of division concerning the pandemic uh how people are treating the pandemic uh how people are treating to be vaccinated or not vaccinated and so I'm thankful that the board is making decisions that will positively impact our school Community um and
136I just wanted to say a couple things uh a quote from Martin Luther King Jr which says the ultimate measure of a man is not where he stands in moments of comfort and convenience but where he stands at times of Challenge and controversy and I want to thank all those who serve in leadership in our school district they are are in they are serving in very challenging times and it is clear and evident that we need to focus on social emotional health I want to thank Dr Amy amazan and Dr Ana artigas and all those counselors who work on social emotional health emotional intelligence is so important it's the ability to perceive control and evaluate our motions and if we going if we're going to endure as a district we have got to focus on
137our social and emotional health and the things which will allow us to be successful together and not those things that divide us thank you very much for listening thank you Miss ton Madame President at this time we have no more speakers thank you yes thank you so much Miss telton so at this time I'm I'm going to call for the vote and I'm going to call your name as yes I just had a point of clarification because you know like the motion was amended um I had that you know to take off the last part um that's what trusty um fam said so we're just adding that the last piece which is to um to add to the resolution co9 vaccinations correct adding to what trusty fam had initially said to take off the last
138part of the resolution trusty B yes so so okay so yes to take to take off the last paragraph of the resolution and to amend the title of the resolution to say res board member covid vaccinations uh you know so we amend amend the so take you know take out the last again take out the last parag gra of the resolution and amend the title to State Board member covid vaccinations okay I got that thank you thank you Manel okay uh now that we have it clear I'm gonna go ahead and call for your vote uh trusty Beano hi trusty Chavez no trusty fam I vice president kto I and myself I thank you uh moving on to back to 501 uh approving out ofate travel for uh trusty Chavez uh trusty Chavez I think
139you had some information you wanted to clarify on this yeah um this is for uh I remember you mentioning that as a matter of fact um president Cina that um you wish it you didn't have to do your job right um as an off officer uh well this program is to actually help the kids so that they don't have to lock them up and so um the amount on the I guess every trustee received this information from Global justice so it's supposed to be 195 and 464 in change the flight since I paid for it two months ago uh I got it a lot cheaper um it was also available in Las Vegas but it was for a lot more days and I decided to go to Massachusetts because it was two days only and
140it was cheaper so um if you vote for it it's fine if you don't for it that's fine too but I want to be able to come back with the information to help these kids keep them out of jail and these people have been doing it um I think 27 years and it's worldwide and I sent you guys also the youth Global Justice movement um a picture of how much it actually cost uh because I questioned it to Dr Bower how come it said so much when I had said that I would pay for my hotel and for my meal expenses so um I just want to let the board know that it's 600 and uh I sent the 464 for the airfare and 195 so if you add that up it's um it's less
141than 700 um it's 600 and something but the thing is is what this is is it's another way to help the kids and it and they're motto is we are here to help you not to judge you so this is actually um instead of going to court to try and help the kids uh go through a program so that that way they can learn basically how to stay out of trouble and the reason that I'm really interested in this is because my kids when they were younger um they did something they shouldn't have and they went through a program like this and there was a panel uh from the community and it really helped and guided them and um they they didn't do anything like as far as community service it wasn't that severe it
142was minor but it did put them on track to saying hey you know don't go through the court system stay out of the system and you know we can help you and mentor to you and this is basically just people mentoring to others it's all volunt and that's why I wanted to go over there to learn more about it they have one in Southern California but I the main offices and where they started it is over there in Massachusetts and that's why I wanted to go over there so that I can come back with the information and help community over here later that's it thank you thank you trusty Chavez and you had me thinking I said I said I didn't want to be an officer but not then I remembered and I just to
143clarify I love my job and I you you know I like what I do as an officer and yes I do want to end the incarceration for our youth um I I always excuse me for interrupting I always remember you saying that and I was going to send you um or the board out but because I it was going to be voted on I didn't want to send that information because for one it's a violation of the brown act and for two I I really think that that's good that you always have that in the back of your mind how can we keep these kids out yes you know and and it was really worthwhile when my kids went through it that's all thank you thank you trusty Chavez and uh yeah so thank you
144for bringing that and thank you for going thank you for bringing that information back I look forward to hearing more about it um when and if passed of course um honoring my my peers here so I just want to clarify I added the 464 and then the 195 and I have 659 so in my understanding that um you're not asking for 1,650 but you're only asking for 659 is that correct that's correct but I also need um to and from the airport so whatever should we should we leave it at at should we leave it as is and then if you don't use it then it just goes back since we don't know how much rental cars or shuttles are are you okay with that to save the district money even when I went to
145San Diego I never rent a car I don't care if I have to walk five miles 10 miles I won't rent because I don't want to do that extra expense on the district yeah and no no worries I'm not I'm not question want to make sure that you have more than enough and if you don't use it you know even better okay most likely what I'm asking for that's pretty much it because I'll be taking care of the other costs so do you want to then change it to 659 or do you want to leave it as is leave it as is we vote on it and if it's good it's good if it's not it's good okay okay so we'll leave it as is uh it's um 1,650 which you probably won't use even
146maybe half of that we can even lower it let just lower do half you can lower it it's up to you I think we could leave it and if you use half great okay it's up to you though I want to honor what you're asking well if it's gonna affect the boat then let's lower it now I mean my intention is I all I love to support yeah I love to support my peers if you know the money's there we're able to do that okay so I'm gonna go ahead and open it up to trust canano at this time yeah thank you um I just want to forgive my um poor memory I guess I don't it's been such a long time since any of us has has you know done any kind of conferences
147or traveling other than just webinars and online stuff so can you refresh my hemry what is our annual allotment that we have from the district like 5,000 5,000 is that correct that's what I thought it was but I wasn't sure so I mean this Falls well within that and and you know each one of us has the ability to decide you know what we think we would like to attend and if it is to the benefit of the district then you know that's what we do so it looks like truste Chavez I I don't think you have to worry about my vote you're within your 5,000 and and I think that's well within your um right and it does appear to be something that does pertain to the kind of work that we're trying to
148do here in the district so so thank you for that clarification or reminder I guess thank you uh trusty PM you're on mute question to the superintendent so now is this some for the board collectively or is each of our allotments $5,000 each each of our allotment 5,000 we just haven't used it in so long because obviously we were all closed down so it's 5,000 oh wow yeah any other questions comments on this item specifically for truste Chavez going um okay ca I'm gonna open it up for public comment at this time Mr President this time we have no public comment okay I'll wait a couple seconds any now still none okay seeing n I'll come back uh to the trustees and call your name as I see you for the vote trusty theano I
149trusty fam I vice president kto I and myself I and I'll leave trusty Chavez out of it because of conflict of interest interest for herself so uh passes unanimously on our behalf um thank you trust Travis and I look forward to hearing more about it okay thank you all right uh moving on to item 601 approve an audited uh actual Financial reports for 2021 report to the board and an audited actuals as required by law uh Dr Bower thank you Madame President I'm going to uh turn it over to Mr chair good evening thank you Dr Bower um and I do have a short presentation for the board my apologies um try to load up the presentation okay can you see the screen yes we can hear you you and we can see it thank
150you um good evening board president and uh members of the board and the Alam Rock Community uh my name is k Chang I'll be presenting the 2021 and audit actuals this evening um the first slide that will'll start with is um to show you the combined unrestricted restricted general fund uh Revenue that the district receive um last fiscal year in total the district received approximately um 100 49.6 million um of which um 107.8 uh is unrestricted dollars and 41.7 um is restricted dollars and the the the bar graph shows you just breaks down the type of revenues um I won't go into that but they're they're there for your reference this next slide shows the combined um unrestricted general fund expenditures um last year the in total the district spent approximately $134.99 million of which
15180 close to $80 million it is in the unrestricted general fund and 54.8 of which um is UN is in the restricted general fund and again this uh P graph shows um the different type of expenditures um that's still for your reference this slides right here shows um a summary of the unrestricted um and restricted uh general fund uh both revenue and expenditures uh we'll start with the unrestricted uh column first um which shows that we started the year um at approximately with approximately $ 122.4 million in uh beginning bin um in that year the districts received um a little over or approximately $17.8 million in Revenue um in terms of expenditure the district spent um approximately $80 million um of in expenditures um there's oops there was a $21.9 million of contribution from the
152restricted I'm sorry from the unrestricted to the restricted general fund um the districts did incur a savings of $5.8 uh million adding to the general fund to bring it up to 18. uh 27 um in reserve uh ending the year for 2021 now in terms of percentage wise um 18.2 represent about 13.5% um in reserve level onto the restricted side um the districts started the year with approximately $2.2 million um we received uh$ 41.7 million in restricted Revenue um and spent $ 54.8 million in expenditures uh received receiving 21.4 um of contributions from the unrestricted um general fund um also adding to the um to the fund balance of about 8.4 to end the year on the restricted side of 10.6 million um this graph or this slides right here shows you um the details
153of all the restricted general fund uh ending balance um as you can see the bulk of it um is for lottery which is about 1.2 um and then the other big portion is the carryover for the expanded learning Opportunity Grant uh about 5.6 um that is uh related to the ab86 grant that was passed um in the spring of 2021 um and then the last row right here for other restricted local um 1.2 and carryover those are um grants from both the state and also um local contributions um from from agencies here and then I'll leave you with this slide this last slide right here um this last slide was taken from school Services which um compiled all the data uh from all the schools uh districts Statewide um just to show repres representation in
154terms of what uh Reserve level on a Statewide average um appears to be um so for unified school districts um most school districts at a Statewide is at 18.2 um Elementary School Districts uh is at 22.7 um and high school districts is at 17.3 um and as as and I do want to highlight that um as an alement school districts um in the previous slide um with the reserve in the unrestricted general fund of 18.2 again um that Reserve level in terms of percentage wise price uh is about 13.5 for alamro and with that I'll take any questions that you may have thank you Mr Chang I'll go ahead and open it up for the trustees at this time any questions or comments and if we're still forming our questions our comments I can open
155it up to public comment and then come back um okay I'm going to go ahead and open it up for public comment at this time Mr Travis if you can uh help us with public comment any members of the public wishing to address the board on this item uh no no public comment at this time okay I'll uh wait a few seconds any now uh still n okay all right um seeing hands from the trustees I'll go ahead and start with truste varano yes thank uh thank you Mr Chang for condensing a fairly large report down to a couple of slides um that's very helpful to kind of get the picture of what we're looking at so just a couple of questions number one um I don't know well you referenced at the end of
156the slides the reserves and we're at about 133% which is that's below what um the average is at a Statewide level and for the different types of districts for so that's a little below what that average is correct what we have in reserves that is correct I believe this last slide I showed you was at 22 is U for Elementary School District um we end at 13.5 and do you recall or do you have off the top of your head where we stood at this time last year what what um what percentage wise roughly did we have in reserve last year um I don't recall specifically but I think we were hovering around 8% not mistaken here okay so we there's been a significant increase in reserves but so now my that leads to my
157next question how much of that increase if any um is related to kind of like these different types of funding that we've received this year specific this year just because of all of the different situations that that have been going on at the Statewide level so I'm sorry go ahead go ahead go ahead okay um now in terms of the um the savings itself it it wasn't really related to any additional funding because a lot of those additional fundings um had restrictions or you know had the parameters around it and so um when we were looking at the summary of the general fund that shows the unrestricted and restricted side you see that on the restricted side uh we did also um had a a a significant um amount of carryover and those were related
158to the uh one-time funds that the district receive and restricted dollars um in terms of the savings that we were able to incur in the general fund um and it was a combination of everything um we had uh in terms of Revenue um we improved about $500,000 which is pretty um pretty small compared to the overall Savings of it um but the majority of it was in uh salaries and benefits um you know we did have a um a huge savings in substitute costs um um and also positions that we were able were not able to fill during the year and then um the other component is um contracts that we had during the year um that didn't materialize um service um for some reason never rendered um so we were able to generate from
159those areas and then the big portion was also um the special programs that the county ran for us um those costs you know significantly reduced as well so that helped a lot to um the the the the savings and also the um the adding to the reserve level okay so looking forward um looking forward do you I mean I I would think that there's still just so many changes potentially on the horizon that it would be hard to predict but do you think that that 133% that we're at is something that um there's a decent likelihood that we could at least remain in that range in the next year if we continue at this at this pace and of continuing to look for savings and revenue or or is it just too difficult to even
160try to predict a year out given the dynamic situation that we're in um if you were to ask me that question two three years ago I think I would probably be able to give you a better um idea in terms of what we're going to be at there's so many uncertainties over the last um couple years and also this year as well um you know just a little Prelude our first item is going to be um significantly different um from our adopted budget because um there's still trailer bills that are coming out um that impacts um both the operation of the districts and also the district's budget financially um so um I don't have to have an answer it's okay but I mean you know our mindset has always been the same um you know
161we're we're continue to save as much as possible um offering you know the most service to our students um that that that are necessarily um but in that same mindset you know there are vacancies that we don't need to fill um you know we'll we'll do that um in order to kind of maintain the stability of the district Finance okay so kind of my last point and speaking to what you just said about the stability of the district finances going forward um is it is it kind of or can it do you think it can be kind of deceiving in some ways when we see some of those numbers um and think that the district has a certain amount of money that we can spend on things that we would want to spend on or
162or expenditures that we have um and the deceiving part being that some of those numbers reflect those one-time funds or is that really not in this because I know you know it's confusing sometimes for the public or for people because they see these big numbers and these monies and it seems like okay well why aren't you doing X Y and Z but as a as a board you know looking forward we we always have to be careful about is this money sustainable can we make longer term decisions based on these numbers so is that one year onetime money kind of reflected in some of these numbers that you presented yes um because I mean one one of the factors that we always have to keep in mind is that um a lot of the fundings
163that we receive are onetime funds um and this savings that we've generated at the end of last year is a one-time savings so anything um that is eating to our budget um that would be ongoing that would be ongoing um the you know the district continue to um go through declining enrollment drastically um and so that's a factor that we'll need to consider um as a part of our budget stabilization um um considerations um but you are right um you know we do have a lot of one-time funds that is masking um the structural deficit um that the districts is currently experiencing um and so you know while we show that we're able to make um or meet um The Reserve requirement that are set that are prescribed by the state um without those one-time
164uh funds that we receive from both the states and the federal government uh we would have to be making significant Cuts immediately um and so those onetime funds are essentially keeping us afloat until we have to make those diff difficult decisions to stabilize our budget okay thank you Mr chair thank you now trusty fam I see your hand up yes mam president question to assistant superintendent Chen in in the second graph you know there was a uh a trans you know a partial transfer of funds from the unrestricted balance bance over to the restricted balance to cover the the Gap in uh restricted revenues and restricted expenditures and I was kind of wondering oh you know would it not be a more effective use of the reserves if uh if if those transfers were sort
165of a bit more surgical just to say that we could transfer just enough of the unrestricted reserves to the restrict uh to the restricted uh expenditure so that way we leave we leave more money you know we we conserve a little bit more in the unrestricted part as opposed to uh you know uh leaving ex I should say U uh how do you say more of our unrestrict uh more of our unrestricted balance bance into the restricted balance may I respond yes yes please um so those transfer from the unrestricted to the restricted uh general fund is kind of um not in our control um the bulk of it is to is contribution to our special ed program and as you may be aware special ed program has been underfunded for as long as we
166and that's why that's why there's always huge contribution from the unrestricted general fund to be able to serve our special ed um programs um in addition to that um about $4 million of it um is required uh for us to transfer to routine maintenance and this is what is a law that is put in place by the state where every district has to contribute 30 uh 3% of their total budget uh for routine meeting so um in terms of being more methodical um we always try to uh you know work with our our own special ed program and also with the county program to keep cost down um but the reality is that um you know special ed is has been underfunded um historically and we continue to be underfunded and so um we'll do
167as best as we can to lower those those amount but some of those cost or transfers is essentially out of our control oh okay and just to clarify you know uh uh what is it um the the legal minimum that it's in reserves of school district must uh maintain is do we have to make a contribution of 3% every year or is just uh it's just the maintenance of the minimum 3% so um The Reserve level is different uh um depending on the size of the district for us is 3% of our uh general fund but it's not 3% only for the current year um it's 3% um in three years out so even if you're 3% in this year um the states the state sees you as ins solvent if in the third year
168out you're not able to make that 3% requirement oh okay so in a sense it almost sounds like you know 3% but if we look you know work it out to third the third year it means that we'd have to have at least a minimum 9% in reserve to kind of make sure that we meet those 3% targets annually yeah your reserve on a yearly basis yeah oh my okay well thank you very much assistant superintendent Chan thank you I see I saw trusty uh Travis's hand up and it's down so just wanted toled yeah thank you he actually asked the the the last question he asked I was going to ask that one so I going on that on the three% maintenance so in our district since a lot of our buildings and Facilities
169need a lot of Maintenance what is the actual percentage word we need to use today this year next year would we is that too hypothetical right now no it's it's not too hypothetical but I mean I I think everyone's aware um the needs um that we have with facilities and the ret maintenance that um that our district is doing is manage to keep School running and keep the lights on um and not you know the bigger projects and that's where the bond programs going eventually have to kick in um with some of those projects but um you know the the maintenance the maintenance program that we currently are operating is mainly just to take care of those um essential stuff that needs to keep the district's running so if you were to put if you
170were to put a dollar ticket on it the 3% how much would that be right now 3% is approximately $4 million okay thank you thank you any other questions or comments from the trustees so thank you for your comments and your questions I think I highlighted a lot of things that I was thinking so I won't reiterate any of that um I do I mean I definitely took that breath of like we're in a much better place right than we've been in the past uh but doesn't mean that we're in a you know let's take care of all the needs because we don't have that much um I know CLA laughed you know and and even the $4 million dollars even though it sounds like a lot really in the big scheme of things of
171all the things that we need barely scratching the surface um but I'm excited right to um to now be able to um focus you know I think of the letters that we received you know um just in general in our district and where we've been about our financial solvency and those uh the places we've been it's definitely a much better place um and I want to thank you uh Mr changen for your uh leadership and for your consistency and hanging in there with us you know and explaining all these questions and being available to draw pictures for us you know when we just don't get it or need to hear it again in a different way I appreciate um you being available um and you know being a big part of that leadership you know
172Dr bow and everybody else to um be where we're at now and just to get better and better right um and I mean at the end of the terms or whatever we all serve that we hope to leave the district in a little better place than we found it um if not a lot so just continuing to do you know our work and what we each do um for this and so at this time I don't see any other hands up um I'll go ahead and call for the vote um on this item is it on for just yes approved right okay um but we haven't do I have any motions or second approv byano second by Chavez all right I'll go ahead and call for the vote uh trusty hi trusty fam hi trusty
173Chavez hi vice president quo hi and myself I passes unanimously thank you um and we'll go ahead and move on to item 602 approve resolution number 10222 Fourth Amendment to the Joint use agreement with kadango to extend the second five-year term for the period July 1st 21 through June 30th 26 motion to approve motion to approve by Chavez second second by truste GTO okay um I'll go ahead and open it up for public comment first and then we'll come back to the um trustees questions and comments uh Mr Chavez if you can help me with any members of the public wishing to address the board on this item uh yes Madam president uh no speakers at this time okay I'll wait a couple seconds any now still n okay all right coming back to the
174trusties any questions comments or concerns on this item okay seeing none we'll go ahead and call for the vote H trusty Beano hi trusty fam hi trusty Chavez hi vice president GTO I and myself I passes unanimously um next item uh before we go to 702 I want to go ahead and uh close the public hearing on uh the Gan limit calculations at this time um also closing the public hearing on uh regarding sufficiency of instructional material at this time all right moving on to 702 approv resolution 72122 week of the school administrator October 10th through the 16th uh Dr Bower I hope that the board supports this um acknowledgement of the hard work our administrators are doing thank you at this time uh go ahead and open it up I do see trusty Chavez
175with your hand up move approval a second approve second by vice president kto okay I'm gonna go ahead and open it up for public comments before we go to trustees uh Mr Chavez any members of the board wish public wishing to address the board on this item uh no public comments at this time okay I'll wait a couple minutes any now uh still none okay uh seeing none I'll go ahead and open it up to trustees any questions comments or concerns on this item truste Bano I just want to say I mean we've talked a lot about the gratitude that we have for all of our staff at all different levels and and you know know every month we it seems like we're recognizing specifically the different um individuals who are serving us and and
176so this one is one of those ones that in particular at to me stands out this year as we've already said it's the difficulty the you know just to navigate and and run a system in your particular site with all of the challenges and all of the changes is almost nothing short of miraculous so I I do you know want to just let all of our administrators know how much we understand acknowledge and appreciate that work that they've done particularly this year and are grateful for that so thank you thank you trusty trusty uh you know Madam president I think that this is just a small token of appreciation for all of our administ Traders uh it's again uh I I would not wish this score here upon any educator and I know so as
177an educator myself uh so for for all the challenges at the last year and a half uh I I strong you know I I support this resolution wholeheartedly as a way to to uh honor and validate the work of our our our site our School site principal and assistant principal you know district office directors assistant superintendents and the superintendent so uh you know pleas you know please take this as a as a small I really I know you know token but sincere token of our uh appreciation for all the work you do thank you thank you trusty fam any others uh trusty Travis uh I don't know how to say all this wishiwashi stuff but I really appreciate everything that the administrators are doing um they are doing a lot more than their job descriptions
178and um it is reflective in and how much you care and how much you're trying to get the education and going forward during this time and it's much appreciated thank you thank you trust Chavez um I just want to mention you know it was an honor to go um with Dr Bower on the first day of school to the different schools and see all the children smiling and playing and being you know back to school after over a year and a half um for all of them about a year and a half or so um and you know that wouldn't have been possible without the hard work of all the administrators ensuring that things were taken care of stocked um and I can only imagine you know I know I'm literally with Dr Bower on
179the phone if not every other every hour every other hour every day it feels like and um you know I can't imagine all the other details you know and I get a lot of details but I can imagine all the other ones that I just don't know about so um just want to you know again honor the work you know of the staff and the teach teachers and without the administrators that back them up they wouldn't be there so thank you administrators for your work and ensuring that you know our teachers have what they need and that our children have what they need in order to go to school every day um and you know there's not enough words or you know acknowledgements that you can receive because I know at the end of the
180day you know sometimes it feels like you might get more of the opposite but just remember that you know you're needed that without you you know some of these children would not be going to school um would not be there smiling keep up the good work um and you know again we're here to support you and if there's anything that you know you feel that is not being fulfilled um I know Dr Bower is also doing you know her best and we're here to support her as well as well as all of you all to continue to uh live out our mission you know of who we represent as alen Rock so thank you all for your work I do see vice president gto's hand up so I'll go ahead and turn it over to
181you before we vote yeah sorry about that um I also just wanted I also just wanted to reiterate uh the appreciation for uh administrators I know that this is uh this is when um um when you know what um differentiates as these tough times is when you have to step up and and so I think that our administrators have done an admirable job under this very tough circumstances to to manage all these changing uh rules all these very very fluid environment so thank you for those who have stuck with us and have helped us continue to move this District forward under the very tough circumstances thank you and at this time I'll go ahead and call for the vote trusty veano hi trusty fam I trusty Chavez I vice president GTO hi and myself I
182passes unanimously uh thank you moving on to 703 approve resolution number 21 number 8 2122 Hispanic Heritage Month September 15 through October 15 uh 2021 motion to approve motion to approve by trusty Chavez do I hear a second second second by trusty withano um I'll go ahead and open it up for public comment and then I'll bring it back to the trustees for any questions comments concerns uh Mr Chavez can you um let us know if there's any members of the public wanting to wish um address the board on this item yes no public comments at this time mad president okay I'll go ahead and wait a few seconds any now still none okay uh coming back to the trustees I see trusty viano's hand up trusty Rano yes thank you um so I just
183want to U make a couple of brief comments on this particular item and I know that in in recent years in particular there's you know we as a society or or you know we have become much more aware of and and had open discussion question s about how people identify themselves and words that we use and things like that and and it's an ongoing discussion and it's just part of you know what we do in in this country um but for me the the word used in here Hispanic is one that's that has been an identifier or use for a long time so it's not one of these um it's not a term that's been come to the Forefront recently it's it's been around for a while and so I will be supporting this because
184I um do understand and believe in the intent behind this and obviously this is a much bigger than just our district and it's something that we're joining on with however I do just want to go ahead and acknowledge it that at least in my opinion um when the word Hispanics is used in this document I think it's referring to a number of um different groups of people that that don't maybe take take very um don't agree with this term myself included and whether you call yourself Mexico Cho mes whatever it is I I think that it's important that when we are talking about the 78% of students in our district that we acknowledge those um indigenous roots that are tied to this land and tied to to um I think what the term is really
185trying to get to so I will support it um I'm not a fan of the word is anics but I understand why it's used here and I just think it's important to acknowledge um the people who I think this is referring to and when we do see you know our playgrounds full and we see the faces of of these students out there you know they're reflective of a of populations of people that um May identify themselves um in a more specific way that is related to their cultural ties to to this land so that's it I will be supporting this thank you thank you any others before I say my comments vice president GTO yeah um I I acknowledge that there's concerns around the word Hispanic um and I also kind of had like gone
186along with it and I very much adopted the more acceptable term in the west coast which is a but I've recently started doing some research on the origins of the word Hispanic and where it came from and it was pretty extensive actually and of really really dug into this because of this constant um issue of like What Hispanic and this and this and that and uh it was very enlightening to see one of the you know seal piece of research was done by a woman out of Stanford who uh bases her history not just on anecdotal stuff or anything like that but actually um she goes back in in the 80s starts uh interviewing individuals who were there uh in the uh in the federal bureaucracy uh at the census which is a Genesis of
187this term and comes to find out that it was a a large group actually a disproportionately large group of Mexicans um that were basically running the show and became the ones who started this little convening this little group of of of the from the from the Bureau of the census where they started telling them this is a term that we want to use and so I continually hear that Nixon went ahead and imposed it on us and to come to find out directly from her she's going from the horse's mouth these individuals are saying this is what we did and this is what we wanted to achieve and so um I understand their their concerns they wanted to be counted they wanted to be a group they wanted they no longer wanted to be just
188uh thrown out there as a separate group of people like in the 30s there was the classification of Mexicans uh to be used as in a in a very very harmful way to go ahead and attack the community in this case they wanted to come up come up with a term and U that was useful to go ahead and demand the right the the access to resources and so um upon doing that research I I see that the term I don't see in the same light as I used to as such such a Negative term because I had been kind of grown into it like you know it's it's a bad thing that it wasn't impos on us and to see this research kind of fascinating to see that the community itself came to some
189sort of conclusion um and it was actually very very bad reasons amongst themselves that they were using to go ahead and push forward this stuff um but yeah I'm from the west coast and I'm tend to be more comfortable with the word Latino and so um I completely understand the the concerns that have been raised already by my colleague in Minister H and I'll understand the other concerns I just wanted to go ahead and um shed some light into this at least from what I from what I was able to to glean from the research and uh yeah I know that we are in in the west coast and we are very more comfortable with latino there are people on the East Coast that are very very comfortable with Hispanic he's just part of the
190very very diverse group of people that we are here as Latinos Hispanics um indigenous people whatever we call ourselves um and so um I'm comfortable moving forward with the word as is um including the word Hispanic Latino um either or indigenous all means thank you thank you H vice president GTO and as a descendant of the Via nation which n Nation I agree with uh with everything that's been said you know trano especially and by uh vice president GTO brand new information to me so thank you for sharing that you know something to add right as we continue to move forward um and personally I I don't feel comfortable with Hispanic and I don't feel fully comfortable with Latino and I get it right that at the end of the day I'm in there under
191that umbrella somewhere somehow um and yeah regardless at the end of the day we you know we each and every one of us gets to continue to move forward with all that we represent you know whatever that means so I honor and respect those that do um and uh for for purposes of this you know resolution as well like trusty Beano mentioned I will be supporting I also know it's a bigger right it's a it's a month it's something that um we support um it's not something that we as a district here come up with but maybe one day you know they'll there will be that term that we all feel yes you know 100% United um but regardless you know at the end of the day right like we're all a mix of a
192beautiful you know indigenous Spanish you know whatever we represent um and it's and it's a beautiful mix of all those grandmas and grandpas that worked hard for each and every on each and every one of us to be here um and represent them all without fighting or saying you're not you know enough or you're more than that or I'm more than you um but each and every one of us you know represent all of those grandmas and grandpas that open those doors for us to sit here right now regardless of what we call ourselves so um proud of all that and with that I'll be supporting this um I don't know if there's any other comments questions concerns mad president yes not to belabor the point or anything I I think it's a very great
193conversation we have and I think it kind of opens up to a to a broader um view of what's going on in the Latino Community for those who may not be of Latino descent and uh I I think it's healthy to go ahead and have these discussions some people might say oh look they're spending all this time it's very important because it it really shows how different our community is there were other individ other groups who came in and wiped out the native population and then sent people off to reservations and chose to move in that fashion and that's one way of uh in which people move uh our our our our culture um uh mixed and created a very complex group of people who uh have to hold competing feelings within one human being
194I have to I I love my Spanish language I love the history that came from um from from those people even though they they were they were in some instances rapists of other parts of my family and Al you know in the in the in the ancient days right and and now they formed this uh this mixed group of people that have a very very complex um you know um existence and uh and we I very much appreciate my language which Spanish I appreciate my indigenous culture and I can hold those feelings without feeling uh as as if I'm betraying one side of the that's because that's just what it is it's a very complex uh you know we're a complex group of mesos that came out of this thank you trusty wano yeah I
195just want to say that I appreciate both uh trusty and trusty's comments because I think that these kinds of conversations um kind of model model or align with or set the tone for the direction that we want to move in um with regards to ethnic studies and all the other work that we're doing in those related areas and and you know I remember as a student I I never forget this I remember as a student in Alam Rock I don't know if anyone is old enough to remember the little what are they used to call them ditos the um like a very old oldfashioned style of copies and we would get little worksheets and I remember we got one I mean credit I guess to the time at least they gave us they were attempting
196maybe but it was about I remember it said like qu Moretta the Bandit or something like that and so you know at that time back in the 70s or 80s in Alam Rock You know I was learning about my people as as Bandits and and these types of things and I went into all the way through college or into college with that as my framework and so and it was at that point point then I was lucky enough to have the opportunity to learn more things but I think as we have these conversations and have these recognitions um it does set the tone for a new way of teaching and and teaching all the trusty ketto said it best the complexities that exist in in our Hispanic Latino whatever you want to call it populations
197and all the other diverse communities that make up alen Rock so I mean we don't want to spend too much time I don't think but I think it's true what is important to have these discussions and begin to move in that direction as we move towards ethnic studies and and some great work in those areas thank you and with that I'll go ahead and uh call the vote I'll go ahead and start trusty Beano Hi H trusty fam hi trusty Chavez hi vice president kto Hi and myself I classes unanimously thank you all right um moving on to 704 approved Next Generation science standards Delta education featuring FAL adoption Elementary School move approval move to approve by vice president second by trano I'm gonna go ahead and open it up for a public comment uh
198first Mr Chavis any members of the public wishing to address the board on this item uh no public comments at this time okay I'll wait a few seconds any now still n okay um moving back to trustees any questions comments concerns trustee kto uh yeah um I know that this isn't the the Next Generation science standard for English language learners but I think it's important that doc Hopefully Dr Bower can can elucidate and uh talk about the role that Alam Rock played in some of the research and we were one of I think two sites or something on the west coast that were um that were selected to do some of that that research for English language Learners Next Generation science standard so if you have any any information off hand uhh Dr Bower through
199the president I would you it would be cool to to kind of just talk about it really briefly yeah please Dr Bower so we were selected that uh one of the people who were part of the writing team for these standards was a professor from Stanford University Guadalupe and I her last Valdez Dr Valdez thank you pryo this was early in my tenure as a superintendent she approached us she wanted to uh use some of our classrooms specifically at Adelante um to see the development the do the development of two languages and how that uh it's an integral part of acquiring academic language so that's another piece that Alam Rock has been uh in the Forefront from uh not only being very um upfront saying we are not factories of long-term English learners but we
200want to be factories and schools that create a pathway for children to develop and be proficient at the academic level in multiple languages specifically specifically English English language development for many many years was treated as a foreign language where students were submitted to a lot of drill and K and that's what generated a lot of what we have in the P we had in the past in terms of English language long-term English language Learners and all research has pointed out to authentic learning and learning about Concepts very Science and Mathematics are an essential component of academic language development because they permeate uh everything that we do as we move forward to college um so thank you trusty Kino for giving me that opportunity uh a lot of the research research that uh Dr Valdez conducted
201was in our schools and we are um very very proud of of what um the contribution that district has made to the to the to the to this area thank you well thank you board president for indulging me Dr V reached out she's like hey I need your help and I said we have a new superintendent who has a PHD and she'll know what you're talking about and won't get lost and so she's like all right let's make it happen so really really proud of Alan Rock's rle in that thank you so much vice president GTO the connections and the Partnerships and Dr Bower for being able to respond and uh accommodate and coordinate and make that happen as well on behalf of all of our our kids and future Generations um any other comments
202questions concerns from any of the board members before we move on to vote all right see Nana call the vote trusty Beano hi trusty fam hi trusty Chavez hi vice president kimto Hi and s i passes unanimously all right moving on to 705 resolution number 11 2122 regarding sufficiency or insufficiency of instructional materials Dr Bower I respect fully as the board to approve this resolution uh the staff and I know um I had uh Mr Sanchez ready for any questions that the board may have um this is part of the Williams uh LA and we have follow up we have had our Williams visits already and um we are in compliance with the materials that need to be available for our students Mr Sanchez do you have any further comment regarding this item um not
203not anything in particular just that um we do an extensive job in ensuring that all of our students have uh the materials that they need the curriculum that they need um anything that uh is missing we work very closely with principles to ensure that all of those things are ordered uh we are going through our Williams audit we went through two schools already and um we things look good and again if there's anything that um a classroom may be short of on uh we are quick to turn around and make sure that we order all those all those materials thank you I do see uh trusty Chavez uh Dr B you have something to add before go ahead Dr bow and then go ahead Dr bow sorry that uh if there if there are any
204missing uh materials in the classroom we have to show proof that we have ordered in order to pass so I just want to be very clear that we have had that the Williams visits have been positive because we have been able to prove to them the Auditors that we have already ordered those materials and so there are potentially some classrooms that are missing a book or two and um the other question that IED was what about the devices um the devices at this point for alumrock are not the way that we deliver our goal is to get to that point the devices themselves are not the are not the the focus of the curriculum I just want to clarify that for everybody who might be thinking you know well my child needed to return the
205device and how come how how are they going to access curriculum textbooks workbooks and such have already been allocated for the sites thank you thank you trusty Travis so first I wanted to make the motion to approve um and then I have some questions if somebody wants a second and then I go through my questions okay second byano go ahead okay so does this mean that some schools are still waiting for material and promethium boards and and also um and and how many schools is that so they're still waiting for them right they're going to get them like in a month or two because I I remember I remember one of the teachers stating that um they didn't have their materials that they were on order but they haven't received them yet in an email
206that we received from the board received so I don't know of that and I will appreciate if you forward that email to me trusty chop okay specific because it's hard for me to tell you we're missing two books on second grade in Linda Vista if that is not the case so I guess what I'm asking is the everybody the majority has it there's just some sites that don't yes so they monitors already came if I can clarify because I think I heard you say something Dr Brower and I believe I know what email do um I'm calling you Doctor chav trusty Chavis is saying is the the email are you referring to the email that we received about the um devices that were missing um where the teacher was missing courts no okay then I
207don't know which one she's talking about yeah no this is yeah make sure you get that yeah yeah okay this is this is something else that was that was you know yeah something else yeah we have many okay just wanted to clarify yeah definitely let's get that to Dr bar any other questions comments concerns on this item uh Mr CH Sanchez I think I saw your hand up you know just one added layer to this is as um we've shared today with Staffing shortages um some of those materials right those few materials that we've been that have been ordered have been Del partly to do with uh Staffing shortages and uh companies really struggling to to produce um those those things right so that's where some of those small you know numbers of of books
208that that may be missing that's where some of the holdup is at but in order to demonstrate as Dr Bower shared with you uh our compliance we have demonstrated that we have ordered everything that is needed thank you okay any other questions comments concerns all right seeing none um I'll go ahead and open it up for public comments U Mr Chavis any members of the public wishing to address the board on this item no comments at this time president okay I'll wait a couple of seconds any now still not okay thank you all right uh seeing none um we'll go ahead and move on to the vote excuse me uh trusty veano hi trusty fam hi trusty Chavez hi vice president kto Hi and myself I passes unanimously thank you trusty Chavez for saying bless
209you um all right um moving on to item 801 um Dr bow any anything to report on that okay um information only thank you any questions comments from the board before we move on to the next item all right seeing n we still I think we still need to take public comment though just that thank you uh CH Mr Travis any members of the public wishing to address the board on the item uh no public comment at this time okay I'll wait a couple seconds any now still n all right um seeing none we'll go ahead and move on to item Madam president yes I would ask that we it's the the items under um item number nine are listed as consent that unless somebody has an item that they want to pull we just
210take 9.01 through 9 9.03 and one and one item okay second second by trusty Chavez any members of the board which to pull any items not pull items but I just want to make sure that we can do that um I know it's under consent but I think I remember before Council telling us that they have to be like pretty similar so I just want to make sure that we can do it okay I am pretty sure but we do have roio on here if we can get roio on our panel to just uh confirm that that is okay Mar if you can uh bring roio he's on and not in the taking a restroom break welcome Roo since it's since it's agendized as consent you know by its very nature it's all in one
211shot there he is hello everyone hi um so the question is so the question is can an item be pulled from consent to either be carried or to be considered separately no I think we can do all of them together on this oh this yes you can actually okay yeah just wanted to make sure thank you the but the motion but to Mr Beano's point the motion should be very specific so that there is a clear record of that I move approval the consent calendar items 9.01 through items 9.03 second thank you for restating that all right uh good to um then call for public comment at this time on these items um Mr Chavez can you please help us with public comment uh yes Madam President we have Miss Brenda sendas miss sendas you
212have two minutes please unmute yourself when you begin speaking the T will [Music] begin hi um good evening board members and superintendent El b um I just want to say thank you um for uh approving or putting this on the agenda to the maintenance team uh to have the miracle PlayStation at Linda Vista I think this has been something that we've been advocating for at the school school and it's nice to see that you know this is actually going to be fixed now because there's a lot of these kids that been wanting to play in this playground and it hasn't been able they haven't been able to use it so I just want to thank the Main's team and all of you guys for um for putting this on the agenda and hopefully approving it
213um and getting our kids that playground they deserve thank you thank you any more uh Mr Chavis uh no more speakers at this time ad president thank you um okay seeing none I'll go ahead and come back to the trustees vice president GTO just uh through the board president um can we get clarification on the silven item the funds that are being used for Sven um are specifically provided by the state for that specific purpose we cannot use them in any other way correct I see Dr bow shaking her head yes Dr I know you know and I I was getting ready later on today to respond to that comment earlier on in public comment funds that are for Extended Learning we are not to use in any other way and as a matter of
214fact the state it's in this new round is increasing those uh dollars for learning loss so I just want to be very clear that we're not able to whenever we bring these items these are restricted funds that are exclusively to be used for that thank you thank you for clarifying that information um any other questions comments concerns from the board all right see none we'll go ahead and move to the vote trusty veano hi trusty fam hi trusty Chavez hi vice president GTO I and myself I all right passes unanimously I'm moving on to the next consent calendar uh 101 approve the whole consent calendar items 101 to items 109 uh Madame President yes I would ask that we pull uh 10 point give me a second and I'll give you the exact number that
215way on not messing up the um 10.09 10.01 10.09 09 okay okay so can I redo that motion approve 10:1 through 10:8 and then we just do the other one separate or you want to take that one first no that's fine now do we have a second for that and then we can go on to 109 second now second okay second for Mr fam so we'll take 10:01 through 10:8 first um I'll go ahead and open it up for public comment first and then come back to any questions comments or concerns from the trustees uh Mr Travis do we have any members of the public wishing to address the board on these items uh yes Madam President we have Eddie Eddie you have two minutes please unmute yourself when you begin speaking the timer will
216begin hi I'm sorry my comment was about the Williams Act I had a question so it's not about this topic so I'm not sure when I can ask that question hello just a reminder to the public um you have two minutes to ask or make any public statement we're unable to respond um as trust this time um yes just want to make sure that I honor it all okay so my my my question is does the board have access to a dashboard that tells you how many um open Action items are at each SK each School regards to deficiencies arounds the Williams act because when you're you're being audited there's there's uh times that you focus on only those schools but in reality there's other schools that have um gaps and there isn't Clarity of
217uh risk exposure because there isn't a dashboard that says um this school has three verified issues around textbooks or X or Y or z uh Prometheans so I just wanted to I I meant to press the button before and I Didn't Do It um and that's it thank you thank you Mr Chavez is uh do we have any other members uh no more speakers at this time thank you all right uh seeing no more we'll go ahead and bring it back to the trustees any questions comments concerns okay seeing none we'll go ahead and move on to the vote uh trusty wano hi uh trusty fam hi trusty Chavez hi vice president Kinto hi and myself I all right that's unanimously now moving to item 109 M president yes yes uh vice president kto you're
218on mute sorry about that I would ask that we approve everything on 109 uh and then we pull out one contract separately that would be the Planned Parenthood contract so that we can vot part that you said that would be what uh within 109 there is an agreement with cl Parenthood I would ask that we go ahead and take that separately second it okay so moved by vice president GTO second by Chavez okay um let's go ahead and move on to public comment at this well go ahead uh trusty veano uh you're on mute I actually have questions about um questions or comments about three of the other contracts not involving the um Planned Parenthood one so I was going to actually pull this item for those three um contracts as well move approval for
219the uh balance of the can you name the the contracts that uh yes it's the fly contract the Health Trust and YMCA did you want to vote on them separately or just you just wanted answer I have qu I have questions about them that may impact my vote as well oh okay Madam pres that's on you figure I'm trying to follow everything okay um so I'm hearing the Planned Parenthood and then there's questions about the other three that uh Tres canano just mentioned I don't know about doing it one by one um I mean I I could just request oh sorry I was going to say I could just request to pull those three and then if you know we could just vote on them separately and that might be the easiest way so we'll
220just pull all four fly Health Trust YMCA and Planned Parenthood and and approve the balancea yes four right I just want to make sure those four okay move appr the balance move to approve the balance second byis sorry I thought TR chus had already second yes okay all right so we'll focus on those first um open it up for public comment first Mr Chavis any members of the public wishing to address a board on the ones that we are focusing on first all of them except the four that we mentioned YMCA the Health Trust fly and um no public comments at this time Madam president okay uh I Will Wait we'll wait a couple seconds any now still none okay all right coming back to the trustees any questions comments or concerns on the ones
221that we are voting on uh trusty Chavez can you list the Heros again please yeah so he pulled YMCA the Health Trust and uh fresh lifelines for youth and then plan was see okay see none we'll go ahead and vote on the on not those but the ones um that are left balance okay the balance thank you trusty Bano hi trusty fam hi trusty chavz hi vice president kimto Hi and myself I all right um now we'll go I guess we'll just go one by one as they are in order um and we'll I guess fly is first I'm sorry yes fly is first well if if I can um Madam president I I can maybe start with the Health Trust that's the easiest one and it's just a just a very brief um reminder
222or clarification I think sometime back we had a discussion about um terminology that we use um and maybe alternatives to use as a district um for the word homeless and I think that is the word that is used in this particular item so I would just um either recommend on this particular item if it's possible to reward that to either um experiencing homelessness or unhoused or or one of those other terms that we had kind of agreed on um and if I can't be done for whatever reason on this item then it just remains as a reminder for the district as we move forward to keep that in mind to help us you know make sure that we recognize those individuals um in that way so if is is it something that we can change
223at this point the wording Dr Bower or or do we need to um take action on it as it is at this point I think we can make a note do uh Dr Beano I'll take it I think we can make a note for the vendor because remember we are engaging in in a transaction here and we can request right uh I think staff has been dealing with the the the the the terms and the labels that the other company also uses so if you okay with it and you can approve it tonight we can certainly make note on this particular contract that in we would prefer to use a different term to to provide those Services is that okay yeah so with that modification or that notation um then I would move to approve
224contct s trusty just so that everybody it's also clear that because this is a contract right we need to have the an agreement with the with a vendor that they are willing to do that I just want to also make that notice okay [Music] um okay so yeah and I think uh I I believe it is unhoused uh but I think just making a note of it right and letting them know um and to be consistent with our policies I believe it's in our policy so the word that we use there I'm in agreement trust Beano we can make note of that uh for them um okay so motion second uh thank you Dr Bower and I'll go ahead and open it up for public comment uh Mr traveis any MERS no public comment at
225this okay I'll wait a couple seconds any now still no okay so see we'll go ahead and go to the vote trusty hi um tra but there was no motion to approve this particular unless I'm incorrect but it's for the health health trust yeah I thought there was byano and second by vice president kto Am I Wrong well the one I captured was trusty kto proving the balance and trusty Chavez the remainder then we got into discussion okay so nobody did I thought no I did that was for everything except these three and the Planned Parenthood yeah we already voted on that Mar so now I believe Beano moved and vice president second yes correct for this one the uh the Health Trust just the Health Trust so are we voting only on the Health
226Trust now or we voting on those four just the Health Trust okay okay so vote trusty veano hi trusty fam hi trusty Chavez I vice president kto I and myself I okay moving on to the next one um I guesso go down your list and then we'll come back to Parenthood okay so my next one is the the fly um contract and so my questions about this one um I think primarily I guess come from the question of why we need this how I read this proposal is that it seems to be a a group or an effort to work with youth who from what I can ascertain seem to be participating in like Criminal or pre-criminal behaviors or activities because it talks about they're going to do case management and they're going to have
227um discussions and education sessions about Youth and the law and so I'm just wondering given the fact that our district at least for the past four years I believe hasn't um you know our suspensions have significantly decreased we have had no expulsion so I'm wondering what the need for this one is particularly with um some of the work that we're doing um in the in oural department and and restorative justice and things like that so I I had brought this up with Dr Bower and I think um hopefully there's some someone from the staff can address that question um okay and Dr bar I'm not sure if you have somebody from the staff and before we move on to the staff um I just want to say having worked with you know the fly program
228I know that they do a great um job um but yeah you know my concern around that and just adding to that is adding anybody or marking anybody with that type of uh background or you know putting anybody in in a list like that or in a class like that yeah and I would agree I'm familiar with fly and I know the work that they do to be good work as well but particular to this our district and we're trying to do that's just kind of the question I got a comment vice president I know that you know them fairly well you've worked with them as well I I obviously when I worked for the Board of Supervisors I got more informed about the work they do have gone to their graduations and seen some
229of the very transformational type of stuff that they do and I get it uh about wanting to steer clear from putting anybody on a particular uh track or you know getting them into an unnecessary program however I think that if there is a student out there that's in a very very tough situation where they're already going down a a very not not to a good path um I think we need all the resources that we have we should have all the resources available uh for that individual to try to get them on the right path and having seen some of the amazing work that they do to get kids um in the right direction um I I wouldn't discourage us from simply saying no to these Services because we think there's a stigma or that
230um yeah and so I all right I hope I kind of explain myself yeah and I do see trusty Chavez's hand up and trusty veano um I I would just add you know the language that we use again you know I think it's just marking the youth um you know I'm in agreement like you know they bring students to the court court room you know I know about like judges and attorneys uh learning about those roles in a positive note and maybe even being inspired to be a judge or I mean it's just a great program um but I would just you know caution us of marking you know the youth um of the at risk of you know I I know there's uh other terms out there that um don't Mark some of our
231youth who are more in need as uh you know at risk or things like that um so yeah I see trusty Chavis is hand up and then trust canano these are the ones that I was talking about of that Justice thing um a lot of kids do not get in trouble in school but that doesn't mean that they're not already in trouble in doing things that they shouldn't be I think that they need to know that they're at risk and what you know avenues that they can go down so I mean I'm in I want to approve this that's all I want to say thanks trust uh yeah I just want to say that um I don't necessarily disagree with um much of what's been said but I guess that's why I'm looking forward to
232hearing from staff tonight because I I don't know that I have enough information about what exactly or or I don't know if I have enough specifics about what I'm approving I would love to see a curriculum or something a little more spe specific just so I could feel more confident in um in what I'm actually voting on and approving here and again I keep in mind the you know a lot of the efforts that we started with our racial Equity Group and and those types of things and so I'm I'm trying to find that balance so I don't know if staff maybe will be able to provide some of that Clarity for me to feel comfortable tonight or if not um you know I just I I don't know if the possibility of of pushing
233this out to another month to get some more specific information but maybe staff can provide tonight that information okay I do see trusty fam's hand up and then we'll go to um Dr Bower trusty fam uh you know to question to the superintendent couldn't we just put a a note like we did with uh the health trust you know I I understand the question of equity I I completely get that uh but you know when we're sometimes when we're dealing with at risk students you know the the balance is also um trying to trying to act you know in an equitable manner but also acting in you know as a school district we also responsible for the safety of all the other students uh so uh and sometimes uh we we have to add sometimes
234uh it's a tough call but if sometimes we have to call State a state sometimes uh if uh I'm glad that fly is a no cost program to the district uh it's and I you know from I I I was launchable legislative staffer so I am somewhat familiar the services that fly offer so uh my I'm I am my inclination is to approve the contract as is with the spirit that um you know if I had to choose between you know seeing a student go down go down a perilous path and you know some and you know with the caveat of yes there might be you know yes that might be temporary you know I I want to stress it it's a temporary C category the whole point of this is to point point the
235child in the right direction and uh you know not not just for them themselves but also uh for the protection of all the other students that we serve in in those classrooms so uh you know let us not let the perfect be the enemy of the good here so uh I you know let's take the opportunity as as they come and approve this contract thank you thank you trusty fam and yeah I'm I'm in agreement as well you know seeing the mentorship the the quality of you know a program that they provide and the youth just the outcomes the examples the many examples in our community of the positive contributing citizens that have come out um I I don't see why not unless you know trusty know you know something that maybe I don't um
236but I'm gonna go to Dr bar because I know she's had a lot of questions to answer so I want to answer have her answer them and then if we have any more you know we can add to that if that's okay um can I say something real quick go ahead we have a motion on the floor right now to approve um good question I don't think if not I want a motion to approve okay and I'll second for purposes of moving forward thank you thank you uh trusty I'm sorry uh superintendent power I think we have staff that we lined up to respond to some of the questions we if I may I'm going to call Mr Sanchez and and you have a couple of people that might be ready to respond to some
237of trusty Beano's questions yes yes um and this is a a long-standing partnership I will add um and um something that our administrators have found very beneficial um but I'll ask Miss uh Norma Flores our director of student services to elaborate a little bit more regarding the partnership so if we can unmute Norma please good evening can you hear me yes good evening Dr Bower Board of Trustees um in terms of the relationship that we've had with fly it's been six years plus um like Mr Sanchez was saying it's been a very positive relationship with quality services to our kids the focal point pre pandemic uh to four of our schools that have fly which is Ren Fischer Ren Matson okal and aptitude and I checked in with principles today they have nothing but good
238things to say about the staff from fly what type of services are are our kids receiving which is mentorship life skill lessons classroom presentations um they also receive mentorship uh active membership in the classroom and out so as of now uh it's extremely positive um no cost to the district uh SLS coordinators make referrals to fly uh we would like to uh get active with him again in the month of October if you approve was there a specific question trusty be I think um well thank you for that actually first that kind of helps to clarify a little my question I think might if I boil down my questions they were going to be um how are youth identified um for this and you said There Will there'll be referrals from SLS correct coordinators which
239I think um you know I think that is appropriate because that it's kind of a a level removed from maybe the classroom so our SLS team can can come from that seal perspective and make an informed referral whether or not this program is appropriate or maybe something else so um so that puts me at ease a little more in terms of just who is identified and how are they referred um because we have some social emotional learning Specialists involved with that referral process and then my second question is what is it that they're learning because what I would hate or what I would not want to have happen um is having some youth that have maybe had some you know that in in need of some prevention or intervention services and then get into a
240group that kind of makes them think that they are um you know headed down a certain path and and is kind of more um leaning towards uh I guess what I'm trying to say is if the focus is more on prevention through education um and experiential learning and things like that I would be very supportive if it's on Intervention and kind of making some of our kids think that they're in this group because they did something wrong or something like that then that's where I would be um you know have a little more question but I think from what I'm hearing from you tonight that those questions that I have I'm comfortable enough given what I already know about fly given our history with them that at this point I think I'm I am comfortable
241in in supporting it but I just again I wanted to bring this up just to make sure that what we're doing is actually align in as best as possible with these other efforts that we've started um in recent months and and we're we're not kind of conflicting or putting a dual kind of uh effort out there so thank you everyone for indulging me my questions and at this point I think I'm comfortable um to support this item thank you trusty for explaining that uh very important very key I'm in agreement and I would um suggest an edit uh I know um Chavez I seconded theemotion um but just on and I don't know if we need to change the motion but [Music] um superintendent if you um can agree to change a wording I have
242an issue on that uh last uh sentence or yeah where it states um at the end 7th and eighth grade students who are identified by the school as being at risk of suspension um I would change it to um services to a limited number of seventh and eighth grade students who would benefit from this program is that we thank you um and I think trusty Chavez you had your hand up and Vice President kto also had his hand up do you have anything to add trusty Chavez okay vice president K I appreciate the clarification from board member because you're right um there used to be like programs that um were supposed to keep kids at are gangs and it turns out like they would like tell a bunch of War Stories and it wind up
243pushing the kids in there glorifying this stuff so I I I know that it's not the right the exact comparison but I the we don't want to have that um the wrong intention of you're trying to keep kids out and instead you're you're pushing them in by by uh prematurely putting them into a program that they're not even supposed to be in so appreciate the clarification sure definitely thank you thank you for your okay um did we open it up for public comment can somebody remind me we did okay so we'll go to the vote trusty Beano hi trusty fam oh hang up sorry Hi trusty Chavez hi vice president K hi and myself I passes unanimously okay the YMCA okay thank you so on this one I had two points that I um just
244wanted to ask or bring up number one um as I mentioned before for different things that we approve approve I would love to see whenever possible and it may not be possible in this case just because of the nature of what is being brought to us but whenever possible I would like to see um some more specifics about the deliverables about the specifics that we are approving for instance the number of duplicated or unduplicated participants projected number of sessions um things like that because if we're approving in this case a $110,000 contract or a 100,000 I think is important that we have a um a as specific as possible idea of what we're actually paying for so that way at the end if we need to we can um you know look at the work
245that was done and compare it with what we had contracted for and and in that way assess the effectiveness of of the program so um so that's that if that could be added to this one I would like it but I don't know if it could in this case but moving forward whenever possible I'd like to see that and then the second thing there is mentioned in the contract about um donations or additional District monies that might be needed to cover the cost of materials um a workbook I believe in this case and it's not a significant amount for the district I don't think um but for parents I if it I just don't want any of our parents to have to to um you know want to participate in a program and then a
246barrier be for them to have to pay and when I talked to Dr Bower she assured me that that's what I already know she got she reassured me that we don't require parents to pay for these types of things um but I just um I I'm a little uncomfortable approving something with an unknown cost so if the district is going to cover the cost of those books because it says it's still in discussion um then that's like we're approving something that's unknown however based on what I can ascertain from the contract I don't think it's a significant amount um but I just want to ensure that um parents will not have to pay for the for these materials and that the district has money from our restricted funding or wherever may come from to cover
247this so that those were my comments or questions thank you uh I don't know superintendent if you have anything to respond to trustan Sure trusty Beano and everybody else that the parents will not pay for any of these materials for the cost of the training trusty Chavez move for the vote move by TR Chavez move to for the boat okay I know if you heard me uh did somebody did somebody uh motion I did just right now yeah yeah I'll I'll second it but I have just one more clarifying question for Dr Bower so um parents won't have to pay and and I mean I think it is a very small amount so you so we do have funding in the district to be able to cover potentially the cost of these materials and it's
248not a significant amount that is that safe to say yes sir all right well thank you for that I don't need to take any more time on that so so that's all I needed thank you everyone okay um I'll go ahead and open it up for public comment on this item U Mr Chavez can you help us identify any members of the public wishing to address board on this item uh no public comments at this point okay I'll wait a couple seconds any now still none okay seeing none we'll go ahead and move to the vote uh trusty Beano hi trusty fam hi trusty Chavez hi vice president GTO I all right passes unanimously last but not least clanned Parenthood uh Madame President uh just move approval move to approve do I have a second

251their lives to be responsible and respectful and those types of things so I think um it's important for our young men as well to get this education so that's it and if you're asking for my vote now I thank you trusty trusty fam I trusty Chavez no uh vice president GTO hi and myself all right all right I think that's it just dou checking the agenda before we um move on to close session um ask you a question how long the break is gonna be can it be longer than six minutes 10 Absol absolutely uh give me one second um I'm going to open it up for public comment on this at this time on any of the items that we will be addressing in close session uh Mr Chavis can you help us with
