001for thank you car thank you Carlos uh at this time um marel if you can please uh go through roll call today is a regular board meeting of June 10th 2021 at 5:30 pm members of the board in attendance president ginaa present vice president Andres Kino president clerk anesto Beano here member Linda Chavez present member mimf present member members of administration superintendent Dr Bower present thank you Mar um at this time if you can please join me and uh doing the pledge of allegiance I pledge of allegiance to the FL thank you and today I'd like to um open the the meeting in honor of our uh VTA victims um and all the families that um continue uh to mourn the loss of our community me members um due to gun violence so um just

002uh want to take a moment of silence um to think of them and and their family members and loved ones at this time thank you okay um now moving on to item 102 um any discussion or modification um to the agenda um if we have any other M yeah Madam president yes um I'd like to go ahead and uh see if my colleagues the board would indulge me and moving 9.05 into consent and then dealing with consent pretty quickly and I can explain my my reasoning um shortly any anybody opposed to moving 905 into consent uh why not have it in public well Madam president since there's been a question would I be able to yeah sure go so what happens with a lot of these organizations Charter Schools they tend to go ahead and

003have a lot of uh public a lot of the children out so they can speak on these items and so for that reason in the past I've always decided to go ahead and move these items fairly quickly early on um so that we don't keep kids awake uh later on they need to be that we deal with things fairly quickly in short order and so that was my reasoning of moving things uh into consent and then ultimately uh dealing with consent uh fairly quickly as it as a like with before item 3.01 so moving 905 into consent and then moving all of the consent calendar after three1 uh correct um anybody opposed to that do we um take a vote after each one or um move do all the changes and then vote I just

004think should be done in public um so that you know nobody says later on something is being hidden it's always better be in yeah and I think just to um clarify so that there's no misconceptions everything would be done in public um um Andres is just asking to move it in our agenda so to be earlier versus later not not in closed session I'm sorry I misunderstood yeah so he's asking to put it under um item 12 consent calendar for board discussion and or action and then moving the entire consent calendar which will be in public after 301 okay I'm fine with that okay um uh just a clarification Madam president yes so with this new so with this new item be item 12.08 I mean because we do have you know just to clarify

005how how this is going you know so I have a better idea how this is going to move here um roel do we just add item 905 under 127 and then if anybody wants to pull that they pull out item 905 that's great correct okay okay thank you so much yeah okay um and then I do want to um make additional changes um if we can move item 100:2 um after 506 nobody's opposed to that [Music] 102 any other changes before moving forward okay see no hands and none um do we vote on the changes roio um no you don't have to okay perfect so um going once going twice if there's anybody opposed to any of the changes otherwise we'll move forward at this time okay um moving on to item two special presentation

006discussion consideration and action um 20 one Dr B go ahead and turn it over to you I'm very pleased this evening to be turning this item over to miss Veronica Talton she is going to give us um uh what is happening with a very special student we have all of our students are special and we love them uh but miss Talton is going to tell us a little bit more about what happened here thank you Miss tton good to see you thank you you good evening board president Herrera Lera board trustees superintendent Bower and Alam Rock employees and community members Marcus Garvey is quoted as saying that a people without the knowledge of their past history origin and culture is like a tree without roots tonight I want to speak about a student of mine

007that is deeply rooted in African-American history and culture when I began teaching in The District in 2019 19 I sought ways to learn more about my students and to find ways to connect with the Greater arusd Community after a discussion with a few students at Joseph George I inquired about establishing a black history club with a social justice emphasis a few weeks later the 1619 Club was formed 1619 is the year that the first Africans were brought enslaved to the Americas and my first student to sign up was Dylan Thomas Dylan Thomas was recently honored by the Santa Clara County Alliance of black Educators for africanamerican history awareness he has shown commitment to the 1619 club and I'm thankful this for the support of his family in this extracurricular involvement Dylan is passionate about black

008history and he shows resilience in the spite in spite of the adversities that he faces this year Dylan was elected to serve as co-president of our club and demonstrated leadership and guidance for younger club members I'm grateful for the support of our superintendent principal Tara Bickford and the Joseph George staff who support the development and growth of the 1619 Club at our school site as an eighth grader Dylan was recently promoted but he helped to lay a foundation for student self-awareness and speaking truth which I hope continue to flourish for years to come I want to thank Dylan and congratulate him on his African-American history awareness County award congratulations to Dylan Thomas thank you and I don't know Dr bow if we're gonna take turns here but I know that we all probably uh want

037I just want to say congratulations and thank you for all the hard work that you guys have been doing and being those first faces faces our kids see but I am going to be a little bit biased tonight in this um item I want I hope Miss Herman is hearing this Miss Herman you were the first teacher my 15y old daughter had 10 years ago um 10 years ago I came from another school where my daughter was tremendously bullying during her kindergarten years and it was really hard for her to trust somebody you were that person that she actually connected to welcome her in in your class in the middle of the year and made her feel welcome and safe and I will never forget that because our first years in elementary and in any

038any school is what marks our kids life if you could see her today and know how much better she's doing and how vocal and happy she is to attend schools um you will be so proud and it was because of you and that courage and that love and the support you gave her so thank you very much Miss Herman being keeping that amazing woman you are teacher and educator and I'm forever grateful to your work and that work that you've done in our kids life thank you have a really good evening Madame President at this time we have no more speakers thank you Jose um thank you again and enjoy uh Dr bow anything you'd like to say before closing this item just want to tell everybody a job well done and enjoy the rest

039of your life and I just got a text from buddy pren who was one of our me lead mechanics from the teamsters and I if I may I I can may I read the text so because he's watching and he says like sorry I couldn't make it I enjoyed every bit of my time with the district and everybody I met and work with I'll always have a good place in my heart for our rock thank you buddy for a good well job well done thanks thank you thank you so much um uh this time we'll go ahead and move on to item 301 um any public members who wish to address the board on any items that are not on agendized today um Jose I'm gonna ask you to help us out with this um

040is there any members of the public wishing to address a board on any items that are not agendized at this point we have one person one speaker Miss Adrien Bain you have two minutes please unmute yourself when you begin speaking the timer will begin uh hello my name is Adrien Bain and one thing that I wanted to talk about that I don't believe is on the agenda is the fact that we still do not have a contract and and the teachers this year we have been working extra hard and the district is getting over $50 million and we're also getting a 5.0% uh Cola money for ongoing and we still don't have a contract we still are not getting a raise cost of living has gone up we have done everything that we've been asked

041to do and other districts are giving teachers bonuses they're giving them raises they're keeping them retained what are we doing to making to make sure that teachers are retained that we are a district that people want to go to and we're teachers are happy and they want to stay here and when teachers are happy they are much better teachers and we retain students and I know I'll get to this later on in the agenda but we've we've lost students and this is the time to bring us back up bring things better make things better get teachers happier and we need to start thinking forward instead of what's going on right now why don't we have a contract yet and I know that ARA will not be negotiating this summer unless you guys do something so

042do something I don't want to start the year off again without a contract like it has been so many years thank you our next speaker is Miss Jessica Lei you have two minutes Miss Jessica please unmute yourself when you begin speaking the timer will begin hi um my name is Jessica laot I'm also a teacher in alamro and I'm also speaking on the fact that we still don't have a contract and the district is getting over $50 million and they have made it very clear they don't want to put it towards teacher retention increasing staff salary increasing um and it's ridiculous that other districts around the school around the county are getting raises bonuses increase Staffing um and yet our district is making it very clear that they don't want to put it towards uh

043staff and salary and I find that quite ridiculous um and that again it's making teachers who have worked incredibly hard over this entire school year it's like a slap in the face um that what are you going to be using that 50 plus million dollars on if it's not on staff and safe school reopenings and decreasing class sizes with increased staff um and making it safe for staff and students to return so as the summer goes on and area has worked incredibly hard in trying to find a negotiation we're already starting fall off on a bad foot when uh teachers are exhausted and of course staff are exhausted and yet there's no contract yet so please board word listen to the teachers there is $50 million and the district has made it very clear they

044don't want to put it towards the teachers thank you our next speaker is Miss Sandra Riva miss rera you have two minutes please unmute yourself when you begin speaking the timer will begin hello my name is my name is Sandra AA and I am the area vice president I here tonight to speak on behalf of the teachers and ask that the board please um in order to provide the education that the students deserve in alamro as a school board you can direct the district negotiating team to reach a fair and reasonable agreement so that we can continue to attract and retain highly qualified teachers highly qualified teachers is something that Alam Rock has been known for throughout with our music programs and all the offerings that we have and when the district is receiving 5.0%

045Cola in ongoing money your teachers have not been given a raise in over two years our salary schedule is being set to decrease for what is the three working days that we were not doing for our professional development but in those two years we didn't get a raise either so to deduct our pay and then to not bring to the table a fair and just salary offering is something that is very hurtful and demeaning to me as an educator having spent 16 years in this District I would like to ask that you guys go back direct your District negotiating team to please present to area a fair and just contract thank you thank you Miss Rea our next speaker is Sean s Mr swis you have two minutes please unmute yourself when you begin speaking

046the timer will begin hi there my name is Sean SS and I'm I work at dorsa elementary school it's like the rest of the teachers I do would like the I would like the board members to get involved to find out where that $50 million is going um how it can be help how it can help not only the students but it needs to help the students and the teachers and yes they has to help the district too but we've been doing a lot of work this year as you know on online learning was tough um so could you please take a look at where that money is going where the district is is sending it to or spending it on in addition Dr Bowers printed something out when she sent out the flyer um

047email about the last days of school thank you for all your hard work and everything you've done she says tough times don't last but tough teams do it seems like our tough times are always lasting in this uh District so Dr Bower if you really mean it and you don't want our tough times to last any longer please please settle our contract help us out so that we can all have a cost of living expense we can all feel um honored in our district thank you thank you our next speaker is Miss mosa miss mendosa you have two minutes please unmute yourself when you begin speaking the timer will begin evening board members and superintendent my name is theind mendosa and I'm a teacher and I agree with my colleagues please consider a fair and

048just contract as you know area will consider reasonable offers during the summer so please thank you thank you Miss mosa at this time we have no more speakers thank you um and at this time we're going to go ahead and move as we shifted the agenda over to the consent calendar so um if my peers can join me over to um item 12 consent calendar which will be including 905 as well all right um uh Madam president yes trusty faman I'd like to pull you know uh item 9.05 uh or I should say move to PLL item 9.05 and move to approve uh the rest the remaining items of the consent [Music] calendar I have a question on some of the expenditures um you want to pull something else yeah it was um actually the

049$290,000 one of them was before we go into the details do you know do you know what item that is and if you want to second with an amendment to what trusty fam is proposing to pull the item okay do that do his first and then I'll get you mine maybe we can uh include it in the same vote so we'll pull 905 and then sounds like Chavez you have another item to pull otherwise we're gonna um approve it so I want to make sure we pull it before we go through with trusty fam's um do you have your hand up trusty fam oh no no no I okay I just want to make sure okay there was anything else um it's okay I'll have a meeting with uh Dr Bower and hopefully Chang over

050those things I don't want to hold up the meeting on a bunch of questions on that okay do you uh do you second it or I'll go ahead and second it for uh purposes of moving the meeting forward so uh trusty fam um is just pulling 905 um and all the other items right yes okay um before we take the vote um I'm going to go ahead and open it up for public comment at this time so actually Madame President we have one speaker give me one second Jose I think I'm not sure if trusty Chavez is trying to say something yes it was 12:03 so you are um asking to pull 1203 yes as well okay so you changed your mind that's the item you were talking about yes okay all right um trusty

051fam do you accept that amendment I accept the amendment okay so I'll second that so we're pulling 9:05 and 1203 okay I apologize Jose um going back to you do we have any members of the public wishing to address the board yes madame president at the moment we have one speaker Miss Sandra Riva miss rera you have two minutes please unmute yourself when you begin speaking the timer will begin so just so I'm understanding this is comment for 9.05 correct no um we pulled that one we'll be uh hearing that one separately right now we're just passing the consent calendar which includes 121 122 124 125 126 and 1207 thank you for clarifying I have some feedback noise here so I will wait and make my comment in a minute great thank [Music] you we

052have our uh excuse me uh one more speaker Miss Francesca gonado miss gonado you have two minutes please unmute yourself when you begin speaking the timer will begin is she there miss miss corono she may be having some technical difficulties Miss Coronado you are muted excuse me uh you are currently unmuted unfortunately we can't hear her um hopefully we can fig figure out the audio issues um I'll go ahead and keep her name and at this time we have no more speakers okay and I'm I'm GNA go ahead and give uh keep Miss uh franccesca name here in case she's able to come back later and wants to speak um okay we'll go go ahead and open up for any comments questions from the board before taking the vote okay seeing none we'll go ahead

053and um take the vote as I see on my screen trusty Viano hi trusty fam hi vice president kto Hi and trusty Chavez J Chavez H sorry there's a bunch of noise back here and your vote is I said I okay I wasn't clear I just want to make sure we have that down thank you so much we're go ahead then and come back to items 9:05 at this time approve Alpha Public Schools California Environmental Quality act uh report let me switch my books over back okay uh trusty fam I know you pulled this item would you like to um well uh I I well Phil hello if we can just make a motion just to go through the motions make a motion get a second for purposes of a of a if I can

054get a motion first from anybody no for purposes of discussion and then we'll vote at the end Madame President can we hear first what the uh the rationale for pulling it before we know what to motion on because I I think the motion might depend on what the thinking is behind pulling it just a a thought sure if I may if I may answer uh trust yeah sure we could do it that way uh you know I P it you know I I am I was not on the board when you know the original Agreements are uh uh were drafted uh I just you know given the fact that the you know the edit you know I read through the report you know having some experience with land use uh you know from the open

055space Authority you know even though there are still some concerns that I have and I'm also concerned at the fact that the edits were the requested edits were submitted uh by Alpha past the 4:30 pm deadline yesterday and the fact that uh you know uh uh you know there you know I I have I have concerns about this particular deal uh in regards to you know in regards to the fact that you know this uh I believe that the Charter School uh operator uh is not being upfront and honest with the district okay Madam president yes board vice president GTO you had asked for a I'll go ahead and I'll make one appr second thank you uh so uh motion made by trusty kto second by trusty Chavez um I see your hand up trusty

056hanano yes um I also I I did read the initial report and I was prepared to um you know take a position on that however um kind of congruent with trusty with what trusty fam has has stated the edits that came in um I was not able just because of the time they came in and my work schedule today during the day I have not had a chance to review those edits so I would not be able to um I I think I I wouldn't be able to vote on this item because I don't I haven't had the time to review those edits so I would either be in favor of tabling it or or else I may have to abstain from this item just because I have not had the opportunity to read those

057um edits as they came in uh I believe just before midnight last night um and I just didn't have a chance to read them okay uh trust uh board vice president kto yeah so um with uh with regard to my colleague's uh comments uh I'd like to respond to that and you know I I I think I've I've been pretty vocal about my position with public privately operated publicly funded schools like I just got a bullseye last month or a couple weeks ago because of my position on the on on the schools being very very open about it um however there's all there's a difference between um uh between uh comments that you make and a governing and we do have people that we have to partner with that are here if I have the

058ability I told this to uh Charter operators who've come before us that my goal is to make sure be shut down not in a nefarious Way by doing bad stuff but by being the the District of choice the schools of choice that bring our students back and so that's the one way in which I see that we can go ahead and if we take if we bring back our students be able to essentially shut them down um however I I wouldn't go about it by withholding things that need in order to be able to operate because kids are still there um and uh some of them happen to live in our district and so therefore um it's for that reason that I would even though I've been very very open very clear about my position

059um I you have to negotiate with folks that are already here and they have the educational futures of our children in their hands and so you know sometimes times you have to be able to govern you you must govern and that's for that reason I my gut would say no I'm not gonna do anything to support you and I would be I would feel I would probably feel very good about that I know I would but I have to look at the bigger picture and be able to negotiate to move things forward so they can go ahead and provide the things that our kids need that they have I'm hoping that at one point in time we can entice enough of a kids back that they're no longer there and I I I I've been

060very very open about that I don't hide it that I want our our district to be the schools of choice that eventually lead to not needing any charter schools within our district but unfortunately that's not the reality right now and uh I've read I've read the the the report it's in line with what we had agreed upon as a board in the past through board action uh and and any of the changes that have been made have been made through the request of our staff which is favorable to our district so therefore I'm very I'm com I'm comfortable in moving forward because it's stuff that has been requested by our staff that makes the the the the the agreement more favorable to us so those are my comments thank you I see trusty Travis's hand

061up yes um I also wanted to add that we did did vote for this before and this is for the students and that this is for their education and these are Alam Rock students um and we already saying that we already voted for this and seeing that we passed it before this is basically when you say we're gonna pass it this is what we voted for before to allow them to do this so I think that we should back up our work and vote for it thank you thank you I see trusty fam's hand up okay uh first of all before I respond to my you know uh question to assistant superintendent Chang uh you know you know uh What uh why was this brought up at this time uh you know was this at

062the request of alpha or no um trusty fam um can you clarify your question in terms of you know I guess the thing is you know given that you know given that Alpha was late in its submitt and you know uh you know when when yes so first of all given that Alpha was late late in its middle you know uh what was what is the rationale for staff uh for bringing this item up at this particular board meeting well I think we were trying to work with Alpha because um you know the the project is kind of sign um time sensitive because they uh we planning on getting the Portables installed at at the school sites during the summer time um and so I believe the board approved the um facility uses agreement back

063in December and ala did conduct a um initial study in terms of the impact on the environment of the installation of the Portables um once the District staff including me and Council R Ruiz rellia Ruiz reviewed the report we had some concerns um we did set up a meeting with ala um representative um and gone through our concerns um and agreed to certain terms of timelines um to be able to bring a report um in any revision that um we're request Ed um so that um so that the board can make the right decisions um in terms of the timing itself um I know it's kind of um a rush timing um but um in our review of the initial study um we also got the recommendation to also um get our own SQL consultant

064um and um and we did do that uh and Alpa did agree to pay for um the SEC consultant that we selected um and I know the timing was rush but uh we were able to work with our SQL consultant to review uh the report that was conducted by um Ela um they did come up with some concerns um and there was a lot of discussions between the districts um and Alpha and eventually um they were able to get um all the items that we requested um and the SEO consultant that we selected um ultimately um concluded that um Alpha did provide um all the recommendation that we requested and also concluded that um the initial study um is comp is in compliance with sqa um and so you know the timing is was was

065kind of rush but um we we did work um there was a lot of effort to to bring this in order for the board to consider um if Alpa was to make their um timeline in terms of the in ation of affordables during the summer okay and thank you for your work uh assistant superintendent Chang and please I you know this is not meant to be a reflection of your work I I value your your professionalism very highly uh you know if I you know and if they my colleagues will bear with me here we've got a you know it was a lengthy report there so there you know before I you know let me make my marks on this item you know uh as I said I I I was previously Vice chair of

066the citizens advisory committee at the Santa Clara Valley open space Authority so that's why I you know went through this with a a fine tooth comb here and you know I will say this you know uh oh boy uh there's a lot of some background noise or suddenly some background noise here so okay am I still on yeah I think we're getting some feedback from uh Chan so I just muted him and okay very well you know uh on page 22 of the initial study look I mean uh you know uh in response to trusty Chavez I you know uh if it were me we'd be taking more drastic action because you know uh Phil ically I'm you know as I said at my appointment uh you know my my T you know my aim

067on this board is to protect and enhance our uh neighborhood public schools here and that means that I'm not only I'm not only the trustee of the parents and children of this District I'm also the trustee of the teachers the custodians the cafeteria workers and everyone in this District so I I find it very difficult you know that you know even though there is less than a significant impact but we have two uh preschools San Batista and Max elulu uh you know which have will face air pollution risk due to the uh construction dust you know and uh I you know I have difficulties understanding uh why you know uh Alpha has not yet committed to having um measures that exceed the safety standards to ensure the safety of the community as outlined in page

06823 of the of the study uh you know and let's see here and also in regards to uh you know issues of uh you know uh specifying adjustments to ensure traffic safety and access access at the roads are maintained while you know construction is going on uh you know these are all important issues that are facing this community now I I I want to say in all respect that yes you know we have a responsibility govern but you know for my part I was not on board when this agreement was agreed to so I you know I have reservations and I wanted to use this opportunity to express my you know reservations here uh what I think is uh unprofessional behavior on the part of uh Alpha for not only uh submitting you know these

069documents uh so late in the game and all you know not you know when you you know as our teachers say you know you know you can't get full credit you turning your assignments late that's not acceptable uh anywhere any time uh second of of all it's sort of you know uh I am committed to protecting the the health and safety of everyone who lives works and plays in alen rock schools and you know as long as I'm you know I will speak out if I'm not satisfied that you know uh that Alpha is uh treating with disrespect the uh facilities that you know the labor of our uh for forbears have paid for you know that's not you know that's the property of the people of alen rock so that alen rock can educate

070its children you know this is you know I'm not here to invite termites to go in and you know uh for a flat Fe eat all you know rent out apartment complex and eat all the wood here uh you know and finally I am just appalled at the fact that you know you know even even in the waning days of this pandemic in a very very tough year uh you know Alpha would you know do something you know I would say smacks of uh unethical Behavior you know dropping an anvil like this when we are dealing with so you know issues regarding the reopening of schools and you know and you know maintaining clean air you know safe access to roadways so that we can serve all our children uh and lastly you know there

071are question you know uh Al you know the the chief school's officer sherah heg sent an email to all members of the board you know uh regarding the importance of these uh Portables and you know as it relates to the education of uh special education students students and if I remember clearly a year or two I believe two years ago uh one of alpha schools Alpha Cornerstone uh you know Charter renewal was actually denied by Franklin McKinley uh because of issues regarding uh you know the education special education students and minority students and unfortunately that was appealed uh appealed successfully at the County Board education so I'm just saying you know we for my part if I were there I would have stepped back and said you know let's look at this deal let's look

072at Alpha before we you know commit to something and so you know for those reasons uh you know I will leave my respectfully leave my colleagues to uh come to their decisions but uh you know I respectfully desent UR no I'm on mute vice president um and trusty uh veano um we'll go ahead and go with trusty veano and then come back with Board of Vice President G okay yeah um just couple of comments number one uh I believe it was stated by one of my colleagues that we are already voted for this uh and I'm I'm pretty sure that's inaccurate otherwise we wouldn't be voting for it tonight we voted for a related item uh kind of the item that that would precede this um we did vote for that but we have not

073voted for this item yet so that's why it's before us tonight and um I appreciate uh Tristy kto and Mr changen kind of describing um you know the importance of governance and and also the um you know kind of trying to reassure that what we would hope and expect as a district in those revisions are actually um okay are favorable to the district I appreciate that however you know back to the concept of governance I try to whenever possible and I think this is one of the times when it's possible um go with the Mantra of um trust but verify and so although I very much trust you know the word of my colleague um Tristy kto and and Mr changen I just have again have not had the opportunity to verify that for my

074own and I in good conscience I don't think that I can vote on something that I have not you know I have not been able to read just again because of the the time situation that occurred on this so you know I it's based I'm not saying that I would support or don't support I'm not even taking a position I'm just saying I have not had the opportunity to verify for myself whether or not this is something that I could support or need to oppose and so again I'm I'm likely to abstain from this vote just because I did not have the opportunity to get the information for myself vice president yeah so um I appreciate the comments and I think it's good to have a robust discussion I um I also appreciate uh our

075staff's ability to go out there and and have uh the information that was presented to us verified by experts who are experts in their field and so we were provided a memo from placeworks uh who went ahead and reviewed um the the is a summary on District responses uh responses to review comments for Alpha Char School Expansion Project and so that happens to be a document that's provided by an expert in in this field and so he lays out and he says I reviewed the attached documents responding to my June 8th memo which provided comments on Alpha Charter School Expansion Project initial study based on the responses noting that the conditions of approval found on pages 30 31 35 44 71 significant issues that were identified uh were added to the mitigated monitoring reporting plan

076I'm satisfied that this action will provide the necessary linkage demonstr the conditions of approval will be enforced along with identified mitigation me and so um given some of the statements that were made tonight you would think you know if you vote on it you don't care about traffic issues or the health of kids in uh in the surrounding area um I the reason I'm I'm supportive of this is because we've had experts uh that uh uh have uh written a response have provided to us and uh they let us know that um in their expert opinion um they they feel that it satisfies the issues that were raising so therefore I'm comfortable uh moving forward with that based on uh the U the the information that we've received from the expert thank you president GTO

077and um I'm gonna go ahead and say something since all my colleagues have said something and then I I see the hands trusty Chavez and trusty Bano um can I can I just ask can I ask a question of trusty keeto about his just the comment he just made before we move to another one just to clarify question go ahead the thank you the memo that you're referring to truste kto was that pre revision or post is it the one that was in our board book the memo that was included in the initial board book before we got the revision it's dated today June 10th so did that come in an email or was that it was an email sent out to all of us okay so that must have been the issue worked all

078day so I didn't have a chance to catch up on some of those maybe okay thank you for the clar thank you yeah and um I just want you know wanted to take us down memory lane right I know Tristy fam you mentioned how we as a board had discussed this prior to you coming on um and not specific this item but the school and the movement right moving forward um I do also you know want to remind us that there was a time that uh Alpha the same school came and there were some questions about what they were requesting um and what they were asking um at the time um not very transparent um and it felt personally it felt like uh they were being trick you know trying to trick us into proving

079something that we had not agreed on um and so you know that that part of me that uh governing piece I you can't forget those things and so when we had this come up I wanted to ensure that you know everything that we had discussed um that was in there and that it wasn't anymore you know that that we had talked about um in the past um so there was some things that were important for me when I was reviewing this um that uh luckily at this time you know um it was covered uh we had our Council roio review this um as uh vice president kto mention we also had our um another uh reviewer in addition to our Council um and so you know it was one of those items where I was

080like well can we just table because there's so much um and uh after the edits that came in late which you know I'm hoping that if Alpha you know anybody's here um we just ask you know just like we ask our staff right to give us enough time so that we able to review but being that our um the reviewer to reassure us was able to review those documents um did it um you know I I feel okay being that we have I was able to review it we have our Council and then we have the additional um reviewer who took the time um to look to look through it um so at this time I will be supporting it um and I respect my you know peers and your thoughts and and and where

081you're at um I do see two other hands so we're going to go with trusty Chavez trusty Gano and then we'll go over to the public um comments on this item I was just gonna say can we vote thank you trusty wano yes thank you um so if I can clarify I guess with staff on this email that came to us today um I guess it was at one something 135 145 and so as I mentioned you know just because of work I wasn't a I wasn't able to see this email so the memo that I believe trusty kto was referring to from Steve Noak uh place works the the items the conditions of approval that he's referring to are those the the edits that were sent back to us so is this memo basically

082saying that um the edits that were sent to us or the revisions that were sent to us last night from alpha are satisfactory is that basically what this memo is saying then is that clear that whoever question I don't know if I need to ask the question in a different way I'm basically trying to find out is if this memo addresses the the items that came to us late last night president I can answer question if you like yes thank you yes um so the original the original initial study had included in it conditions of approval but the study was broader in scope than this board had agreed to last year as part of the facility's use agreement and so part of this uh iterative process back and forth process with Alpha was was to

083point out the breadth of their initial study and that we believe that it had to be tailored specifically to what was allowed or what is allowed in facility's use agreement so their initial study was uh initial initial study was much broader um but the conditions of approval have remained the same um the what the expert what the district's Independence per review expert has advised the district is to incorporate some changes so that the conditions of approval namely the mitigation measures become enforcable by the district through the uh initial or through the sqa process if there is any violation in the future so the conditions of approval have not changed from the uh from the from the first in uh first draft of the initial study it's just been a process of tightening the enforcement mechanisms

084for the benefit of the district okay so then this memo does or does not address those revisions that came to us last night it it does it it the revisions that went to you last night were edits to the document to tighten up the enforcement measures okay but the but the independent expert agre agrees with the conditions of approval okay so then if I could just thank you for that U Mr Riz and I'll just make a statement then as I as I mentioned a few minutes ago I I will I need to do govern you know kind of using that Mantra of trust but verify and to me um this memo seems to be a verification of what we what from our end um is maybe in the best interest of of the district

085based on the the um cons consultation that we received and what our staff is recommending so that being the case um at this time I'm leaning towards um supporting this particular item again just because I see here now verification of um what I had needed to see in order to feel comfortable supporting this so I'm interested to hear what the public may say but at this time I I believe I I may be able to vote on this item as opposed to upstanding thank you um and I had mentioned that we were going to go to public comment but I do see trusty Chavez's hand up um is there something you want to say before public comment okay so we'll go ahead and J if you can help me out with the public comment is

086there any members of the public wishing to address the board on this item yes board President we have six speakers our first speaker is Francesca Coronado Miss Coronado you have two minutes please unmute yourself when you begin speaking the timer will begin and I know we were having issues um can you hear me now yes oh I'm so sorry my students know more than I do I'm so ignorant when it comes to technology I apologize um okay really quickly um two things that are of a concern to me um one one is it would be nice I should first preface uh what I want to say by letting everybody know I do want to return uh to a school I can't wait I'm in Aid with special needs students and it's been a long year

087just for I guess like for everybody else and I'm excited about returning however I think that the district should just look at Gilroy Unified School District and uh they use them as an example they're going to provide a um uh online option and they're going to be sending out a survey to their parents at the end of the summer to see how many of the parents want their children to return uh on site or online um I realized that it's much better for them educationally to be on site and socially and emotionally but I think that also um it wouldn't hurt to just air on the side of caution and be very careful about how we ease you know how we transition back to um on-site learning um I I just don't think it would

088hurt to provide that option and then another issue that's really important to me is um I'm hoping at some point Alam brck can uh open up their libraries again um we've been without libraries and it just befuddles me that a a learning institution does not provide books for their students um believe it or not a lot of my students they don't realize there are libraries at there public libraries I've had to explain to them that they there they are there especially the uh Roberto Cruz on Alam Rock they' probably passed it many times and didn't even realize it but um if if Alam Rock could find a way to open up the libraries it would be a blessing and I thank you for allowing me this time take care thank you Miss gonado Jose I

089may say something before we move forward um we did allow Miss gonado to speak on other items because she was having audio issue so I did mention that I would allow her to speak on um on the items she was trying to speak on earlier I just want to remind um those that are on for uh public comment at this time that we are addressing only the approved Alpha Public Schools California Environ Environmental Quality act report um so just a reminder thank you J yes our next speaker is Miss Sandra rera miss rera you have two minutes please unmute yourself when you begin speaking the timer will begin good evening Bo my name is Sandra Rivera and I am coming tonight to speak on behalf of um the alumrock Educators Association which are the teachers

090and while I understand that this is for the approval of the report what is very disturbing to me is the fact that we're looking to while we just closed two of our Junior highs and had a huge repurposing committee and um trying to figure out how many schools we were going to close this year we're considering having more Portables put onto a campus and having more of our students go away from our alumrock schools and not here staying close to home thinking about ways that that money from the Portables could be spent on our alumrock students and so as a teacher that has been affected by Alpha being saloner being closed pushed out of our schools and now trying to capture another 180 to 190 students with eight more teaching positions going to the charter

091schools with this bill um being passed through you guys I would just like to ask that the board consider the students and staff and teachers who are here fighting for Alam Rock schools within our district your dependent schools not the charters that are coming and invading our spaces thank you thank you Miss Rivera our next speaker is Miss Joselyn muris miss muris you have two minutes please unmute yourself when you begin speaking the timer will begin okay thank you and I um I want to piggyback on what Sandra Rivera said I think she hit on a lot of the points that I also want to touch on as I read I did read through the board book and and read through the QA report um regarding Alpha's intent to add six more Portables which like

092Sandra had said would include another 190 students and eight more teaching positions um I understand that this is less than what they were originally seeking but at what point is this board going to connect the dots that the more rooms and the more space that we allow to the charters the more Decline and enrollment we are going to experience it's common knowledge that the surrounding Charters share a common goal to chip away at the alumrock school district school by school student by student and while it's been brought up we may not have control over what was previously approved in December um when there was an a an approval of the increase in rooms allowed to Alpha it is time that we need to put a stop moving forward on allowing the charters to increase or

093there won't be an alumrock School District I mean that there are two schools on that site both Alpha and the combination of students on that site is larger than any one of our single middle schools I mean and now they want to add more um yeah please stop and take a look at it moving forward thank you thank you miss m our next speaker is en organizing a member from U speaker you have two minutes please unmute yourself when you begin speaking the timer will begin hello my name is Lisa Gonzalez once again a parent and Community Advocate as a parent that um as an advocate that has have to revise the agenda and the board book and go through the pages and all that information that there is I would like to um call

094into accountability to anybody right even if it is Alpha and I have done it with the board with the board members as well in the in the um board book and also on the brown act it says that that any paperwork has to be submitted 72 hours prior to um before the board meeting and I and I have a knowledge and I understand that there weren a significant or a lot of changes through through what it was presented but as I recall from the past conversation you guys had ala had um given you or send you an email with ad with additional information or or updated information about um where you guys are speaking today this is unacceptable B that there are um leaders Bas that we have teachers Bas that we have a lot

095of people putting commitment to go over this agenda to go over what is been talk about and to hear last minute that there's still last minute information that is not added on the board book I don't think it's fair I don't think it's accountability and I don't think it's transparency for the community that you guys are representing I cannot tell you to to vote Yes or No but keep that in mind when we're voting are we really going to be allowing um this kind of accountability from people that are here um asking you guys to putot on something when the the rest of the community is not getting the same information when it's supposed to be open um thank you have a really good evening thank you our next speaker is Miss Jessica lei Madam

096president before have two minutes please unmute yourself when you begin speaking the timer will begin you can please pause sorry for interrupting I hear Jano are you is everything okay I just wonder if I could ask a clarifying question just based on the fact that there was a question with regards to Brown act compliance in the past in the previous comment so I just want to um clear that up and confer with our legal council whether we in on this item all the brown act requirements have been adhered to uh sure thank you can answer yes please so what the brown act requires is that the item be agendized properly for Action which this item is it also requires that um within that 72-hour posting period that if there is any information documentary information being

097provided to the board regarding the item uh that is non-confidential that it also be made publicly available so uh the the information that was being provided to the board was also being posted on the uh District's website in connection with this this evening's meeting so that information uh is on the district's website okay thank you I just wanted to clarify to the public that we are we don't have a violation here for brown act and we're good thank you thank you um I apologize Jessica uh as soon as you begin speaking the timer will begin thank you um yeah I just want to piggyback off of my fellow area members that we need to really keep an eye on what is going on here and that the the alpha charter school is you know just

098invading our our property um and that as we have repurposed and gone through consolidations of our middle schools here we go giving more space to Charters and what that means in the sense that there's going to be six more Portables and 180 more students and eight more staff and what Jocelyn mentioned that it's just chipping away at our own student population and for what benefit um and that we just went through a consolidation so it just doesn't make sense that we are allowing this to happen um allowing more charter schools on our land taking away our students um and not bringing them in they're taking them away um so if we allow this to happen we again are shrinking our own personal district and there's no benefit in that so please consider our staff and

099our students as your intent to increase Alpha's footprint on Alam Rock's proper property is is invading our own space as an Alam Rock Unified School District so please consider and carefully consider this vote to allow a charter school to increase their space um even more on Alamar property thank you thank you our next speaker is Miss Dina Lopes Miss Lopes you have two minutes please unmute yourself when you begin speaking the time will begin hi um I'm usually pretty prepared to speak at board meetings and I don't quite know how to articulate my feelings right now um I'm very disgusted and disappointed with our board which breaks my heart because compared to the board we used to have when this new board came I was so excited thinking finally we have people in charge who

100really genuinely are here for the Alam Rock School District yet I'm noticing that we continue to be like the nasty stepchild we need things we can't get them my kids go to molum they still don't have AC yet Charter Schools ask for things and they somehow miraculously always get it I'm not going to pretend to understand the law and the business because I didn't become a teacher to be a business woman but we're concerned with our enrollment what do you think is going to happen of course we're going to continue to lose kids when their schools continue to expand and expand and look so beautiful look at okola they DCP has this monstrosity next to them if I'm a parent and I don't understand what really goes on there of of course I'm going to

101go over there I don't understand what is going on with this school board I don't get the business piece of it and I don't care about the business piece of it I care about our kids because you know what the kids that are at our our schools are just as important as the kids that go to these charter schools these charter schools that are flashy at the beginning and then send their kids right back to us when they can't handle them I I I just I'm flabbergasted but it doesn't really matter because you know they're going to get what they want thank you is that it Jose uh no we have six more speakers for president our next speaker is Miss Adrien Bay Miss vain you have two minutes please unmute yourself when you begin

102speaking the timer will begin all right first off I would like to say that I um appreciate you know the position that you are in and it is a hard position but and I I I want to be as respectful as possible but do you know how insulting it is when two months ago you closed down two of our middle schools and now you sit there and say let's expand these Charter Schools do you know how insulting it is to us teachers saying that we're not as important as the charter schools M and it's to me it seems like you've already voted and that's what's sad is that even though changes were made last minute you've already voted and already made a decision and the thing with the charter schools yeah they're going to expand

103but then when those kids that can't make the grade they kick them out they send them back to us believe you me as a middle school teacher I have had so many kids come in the last few months of school just for testing from those charter schools and it's not okay you guys are hypocrites if you vote on this by allowing our schools to close and allowing those schools to expand please I am trying to be respectful but this year has already been very upsetting and please stop doing this to us thank you thank you Miss V our next speaker is Chris k m Mr Excuse me I think we Mr K you have two minutes please unmute yourself when you begin speaking the timer will begin thank you uh my name is Chris Kang

104and I work at Alpha and I just want to thank uh you the Board of Trustees for considering this item and allowing me to share a bit of context um and I know that we have many Alpha families and staff on this call excited to hear uh if we can move forward with our facilities project starting tomorrow um as assistant superintendent Chang and um Mr Ru has indicated uh we worked over the past week to resolve some final concerns on uh what this board is approving the squa study um and came to a good resolution in a very very tight time period And I I really want to say that I appreciate their partnership uh and support through the process um and you know we're always committed to approaching this relationship um with in the

105right way I'm not an I'm certainly not an exp in SQL law um but I do have a land use attorney who is um his name is Alan Moore of Wendell Rosen he's on the call if anyone um on the board has any questions um and he can be available um and finally I'll just say that we you know we've been waiting for a couple months for this final step of the process in order to begin our work um and without it tonight um we don't think we'll have um the proper classroom space we need for our children uh in the fall at the beginning of the year and so so we hope that you consider this in your decision um thank you so much for your time thank you Mr Kang our next speaker

106is Miss Bianca Wright Miss Wright you have two minutes please unmute yourself when you begin speaking the timer will begin good evening Board of Trustees my name is Bianca Wright this will be my 10th year survey students in our community as both a middle middle school teacher and now a school leader earlier this evening one of the trustees said something that really resonated with me one of you mentioned that regardless of what school our kids attend these are all our students we all serve the same students at Alpha we are committed to serving the students in our Comm community and in your community as well we are asking for the proper space to safely and effectively reopen in the fall we are asking for these Portables so that our students have a place to learn

107so that we can do the work that we as educators are all here and committed to do we' like to continue doing this work of providing the best education that we possibly can and give our students the chance to have that reopening in the fall especially after this really challenging year of primarily distance learning our students are excited to return to school to build Rel relationships with their peers and to have a place where they can safely learn we really appreciate you considering giving us these extra facilities so that we can do this work because what really matters at the end of the day is our students and our students are your students thank you thank you Miss Wright our next speaker is Sean swe Mr please you have two minutes please unmute yourself when

108you begin speaking the timer will begin yes you're on mute Mr s I'm sorry I'm sorry now we can hear you okay um yes I'm sorry about that I was wondering I'll get to the point I was listening to all of you speak now Mr Chang you said the environment study program when when it got completed when did it reach your desk I have a couple questions on that uh the president of the board I have a question that you kept saying that some other reviewer reviewed the the specs but you're not mentioning who that Reviewer is which makes me transparency making me question what's really going on here um Dr Mr fam I'd like to say to you that while you're looking at at Alpha which is great you should be also looking at

109all the other Charter Schools we have about their special population what does that include for their SP special population because usually it just includes speech Does it include RSP students Does it include special day kids who have trouble sitting in classrooms because I know most Charter Schools don't cover that area um so Mr fam if I were you I would look at all the other Charters too in our district about special education in nesto I have a question that earlier you said you weren't going to vote because you didn't have enough time to review it but all of a sudden in the last 10 20 minutes you said oh I'm GNA go ahead and re say yes probably to it because you know um I agree to what these uh other members are saying which

110bothers me and um the teachers at Alpha I'm also interested to know why you said that you've been waiting a couple of months for this to get approved so what's going on I mean if that means a couple months it should have been looked at maybe in May um so the transparency of when the documents are all getting to our school who's reviewing our documents are being aren't very clear you guys aren't very very very clear with us teachers thank you thank you Mr s our next speaker is Jenny Sanchez Miss Sanchez you have two minutes please unmute yourself when you begin speaking the timer will begin hi I'm a proud mother of a couple elra children and I find this very um suspicious now I was reading that they say they currently have around

111like 700 students but because they're going to end up having around a thousand students that's like a 30% increase they need this extra space uh I find that highly unlikely when the growing Trend pretty much everywhere in this area is that it's decline decline decline you know you're shutting down schools you have other schools that you're continuing to shut down and somehow Alpha is miraculously gonna increase student population by 30% therefore you must provide them with these facilities which would be encroaching on our land so I would ask if you guys can please verify you know um the number of students they have because that does not sound right at all that sounds like something that they just pulled out of thin air so they can have a reason to continue to grow and um

112build like on every square inch of that campus it's so please review it I don't believe it and I'm sure most of you don't believe it either that they're going to increase by 30% therefore they must have this additional um classroom space thank you so much thank you Miss Sanchez our next speaker is Veronica Amador Miss Amador please you have two minutes please unmute yourself when you begin speaking the timer will begin so sorry that was an accident I didn't mean to put my hand Jose we can go to the next one thank you miss our next speaker is Miss Tanner Miss Tanner you have two minutes please unmute yourself when you begin speaking the timer will begin hello I'm Miss Tanner I'm back um I I don't want to say the same things as

113my area colleagues have said but I am in total agreement with them um but I just want to talk about it's been ever since I've been in alumrock Charters are taking away our students if Charters are taking away our students it causes us to close school I was at saloner I got excess Salon closed I was at Matson Matson closed I have had to pick a new I had to pick out of very few open positions where I wanted to go for next year I don't want to go to any of those places I liked what I was doing I was good at what I was doing but when I'm considering where to go I have to think oh my gosh is that school going to close next year I wonder if this school's going

114to close in the next two years I don't want to go through this again so even though that looks like a good job for me I don't want to go there so what are you doing to your staff who should be a priority we should be one of your highest priorities we are your assets and it's just difficult so consider consider what you're doing to your own people and to your own facilities thank you thank you Miss Tanner our next speaker is Jessica leot miss leot you have two minutes please unmute yourself when you begin speaking the timer will begin actually um Jose I think Miss leod already spoke yeah I already spoke I'll speak again but I already spoke yeah no thank you our next speaker is Mr Michael polling Mr poing you have

115two minutes please unmute yourself when you begin speaking the timer will begin yes I'm Michael polling I've uh been a teacher at Joseph George for six seven years now and uh again like my other Area Teachers you're degrading your staff you're lessening us you're wearing us down and sometimes I think it's purposeful like you're trying to uh just drive away your good experienc teachers and you let these uh bells and whistles Charter Schools come in and like other teachers have said they'll pull a number of students out of our classes they'll send back anybody that they don't want to deal with uh often those kids are more damaged when they returned to us because they've been told they can't hack it they're no good um now I I don't know the alpha school people I'm

116sure there are many good people there but charter schools in general harm the regular General Ed kids and that should be your first priority too many Charter Schools not the teachers in them but the people behind them are in it for the money and they come to Joseph George they get our land really cheap free I suppose I don't know exactly how it works but it's a hell of a deal imagine if these places had to go buy their own land or lease their own pieces of land they wouldn't be making the profits that they do so please reconsider like I know you're supposed to be considering it but it does sound like you've mostly made up your minds so please slow this down and stop it especially since the organization just dropped information in

117at the last minute that's bogus and you're making yourselves look as bad as the previous board and that's pretty darn bad have a good evening thank you Mr polling our last speaker is Shara I will try my best is Shara hedge you have two minutes please unmute yourself when you speaking the timer will begin hello can you hear me yes thank you um and board president jera thank you for the opportunity to speak and trustees also thank you for the opportunity to speak um I I definitely hear what our colleagues and and the Alam Rock Educators Association are saying and I just want to share a few things um that I hope will alleviate some of their concerns uh First Alpha is not expanding we have a charter that delineates how many students we have

118uh we will stick to that number uh you have my word as Alpha's next CEO that that is the case we have no plans for expansion of any additional schools in the alumrock school district um and the cost of adding these Portables will be born 100% by Alpha and as a result of the new facilities use agreement additional Revenue will be given to the district um second I want to just share that the timeline of this Pro of this work has been going on now close to two years um when the approval came through in December we immediately began working with assistant superintendent changen and Council Ruiz on this project and uh to be very honest The District staff is incredibly diligent so this did go on longer and longer because they had lots of

119tough questions that's their job they are diligent they care deeply about the fiscal responsibility that they hold um so I give a lot of credit to do Bower to assistant superintendent Chang and and Council Ruiz for their work here um even though it meant going a little bit slower than maybe we would have liked to but that's their job and they're supposed to ask the tough questions and they did and it was our job to show up and respond um you have our assurances via the email that I sent last night to you just you know asking you to consider this item uh that we will incorporate everything that the independent reviewer shared uh in their report uh into the final study of the squa uh that is that is in writing for you uh

120and you know we intend to stand by that so I thank you so much for your consideration all of our families listening today are are waiting with baited breath but we do appreciate you so much for for working with us and for thinking through this so thank you so much thank you thank you to the speakers at this time Madame President we have no more speakers thank you um and just uh I see uh vice president gto's hand up um and before we go to you um I just want to clarify there was some questioning about about transparency and hiding names and and things like that I just want to make sure that if it wasn't clear uh because all of our documents are public um I will say it out loud uh the um

121there was a question around the reviewers um and that was by Steve Novak from uh placeworks so all that information is public um it is available if you have not received a copy um just want to make sure uh to clarify that we are not here to hide anything and that everything that we get um is available for you to also read uh so I'll go ahead and turn it over to vice president kto is see your hand up yeah um now I completely understand the position that any of uh many have taken tonight and I I share your concerns I share them I've been very public about my position regarding Public Schools regarding those privately operated publicly funded schools um and with that said however I have to take a bigger and broader look

122at what's going on within our district we have a couple of options we can go ahead and um and uh and say you know we're going to hold a firm line not one inch and what does that entail later on at some point in time the triggers are are com into to play and uh we have to start giving facilities if the if it's not at the location where they're at then all of a sudden we have to start providing facilities somewhere else and the idea here is that what does that do that expands the footprint of our competitors they're here tonight they're hearing me it's not like they haven't heard this before expands the footprint of our competitors and so while it seems counterintuitive to you the public to go ahead and take this

123action it's a calculation that I've had to make myself and I'm sure that a decision that other board members probably had to make as to whether or not do we contain our competitors on one site um or do we have them do we spread them around throughout the district and so those are some of the things that we have to contend with so I completely understand your position you've come tonight you opened up the book you saw the agenda you heard some of the comments and so you know it makes sense your position your your your comments are completely logical however those of us who have to look at the bigger picture do have to take into consideration more information uh more the long-term effects of possibly spreading out our competitors throughout the district onto

124sites where they may have a larger footprint that may allow them to attract more of our students and so only reason I I bring that up is to you know give you a little bit of the perspective and some of the reasoning that I have have to uh that I have to uh come to that I have to make in order to make the decisions that I do so I I know that there's nothing that I can say for some of you that's going to make you say that makes complete sense you know all right um not but the fact of the matter is that we're here to govern and I believe I'm doing that so thank you tro you're on mute thank you I appreciate jusy Kino's comments and um I basically Echo those

125comments and I think it's important to understand I I agree I am also of the belief of many of our speakers tonight and and you know to the extent possible where we're able to myself and my colleagues you know several of my colleagues have taken actions that are aligned with some of the perspectives that we've heard tonight U from some of our some of our Public School teachers and and staff um but I think someone said you know I don't understand the business of this I don't want to know the business of this and and that's perfectly fine it makes sense because that's not exactly as the person said that's not what their role is here that's not what they came here for but as truste kto just um stated that kind of is our

126role that is our job to understand to try to make decisions from that lens or from that perspective of the business long-term strategic perspective and so maybe that's why it may seem that there is not a perfect alignment between you know some of those comments and and the actions that we take but we are bound additionally not just to the the realities of the district that we're all concerned about and working very diligently to address but we're also bound to state to Charter School law and and the things that we need to do that we're mandated to do um in December I believe of last year when this vote was taken to allow this I think the request and you can correct me if I'm wrong staff but I think the request came in for

127actually more than what we approved and so we you know keeping in mind those um concerns That We additionally the concerns that we had about the future of the district we we approved some something that was less than what came in because we did have those concerns but again we're Bound by state Charter School law um and so so the other part of that also is that I think again correct me if I'm wrong staff but what we would be approving tonight is this SQL report so we're not necessarily tonight um voting on approval or not of of this this um action or this this proposed plan that that Alpha is putting forth we're voting on the merits of this report the SQL report what's in what's contained within the report as it regards to

128the environmental um realities of of the plan and so the vote that I will be casting tonight is based on the legitimacy of the plan I again I did not I said that I trust but verify what our staff said upon seeing the memo that came in from an expert the one that um trust president ATA referred to that to me is verification that to the extent possible this is what is in the best interest of the district for this at this particular time for this particular item so um you know that's kind of my perspective and again you know we do have we're certainly bound to and committed to the wellbeing of the district to as best as we can but we also do have to look at it from this other lens and

129that also drives some of the decisions that we either choose to make or sometimes are forced to make just because of the legality involved in in the decisions so um that's all I have to say for now thank you trust fam okay uh you know this will be my last comment on the item here uh you know thank you to uh board vice president quino and uh Christy Beano you know governing is a difficult difficult act and yes uh it it it involves you know looking at the big picture all I'm just saying from my end is that I you know I see this big picture too and it comes from a different end and just to U you know uh uh you know uh inform my uh inform trusty Bano uh uh approval of

130the SE equa would allow Alpha to break ground so in a sense you know oh one is the key to the other there so but basically you know and hearing the you know our teachers speak uh you know this is about you know my my take on it is you know Alam Rock first making sure that we you know uh get the that you know making sure that we protect the assets of the residents of alam Rock uh it is you know uh to you know uh I I get it that there's a memo but it is but given the timelines and the way that it has been done uh you know of course I have serious reservations and I you know in invite one of these days the you know the the Chief Executive

131Officer of alpha to write to me and you know in my capacity as truste and uh you know we can you know debate the merits further however you know for the time being you know to me this is kind of you know uh if I'm defending the best interest of this District you know I'm going to dot dot the eyes and cross the tees and you know when some when a a deal is you know after deadlines and uh memos filed you know in the nick of you know in the nick of time before a board meeting that raees red flys you know and and our our teachers are right you know to uh to you know to raise their red flags and let us know that you know some you know something is rotten

132in this you know Alpha is not having the best interest of this District that you know that is certainly you know their sense and you know until I you know have an opportunity to sit down with Alpha you know that is certainly my sense too and so for for those reasons you know I've come to the uh conclusion that for at this time you know I will cast my no vote and I you know my colleagues will uh come to their own decisions on that so again uh it's a complex deal it's too much too soon and you know not you know and uh I wouldn't buy a car without a couple rounds of negotiation and it doesn't look like that uh you know from my perspective alpa's done that so uh you know I

133will be voting no on this item thank you very much thank you trusty fam um so at this time I don't see any other hands up we'll go ahead um I'll make a comment and then we'll take it to the vote um seeing no other hands up um go ahead trusty sorry I I just if I could clarify then with as we're moving into a vote here if I could clarify with legal counsel or whoever could answer this so the vote the motion that I'm anticipating and the vote that we'll take is it correct that we will be voting on the merits of the seel report not necessarily any other parts of this breaking ground or whatever but we are voting on the merits of this report the environmental um study and impact of that's

134contained within the sequel report that is that accurate that that is what we are voting on tonight or is there more that would be included in our um so that would be the vote that is the vote that is before you the motion in the second but just as a reminder when the board approved the facilities use agreement back in December I believe it was that agreement allowed Alpha to install up to six additional Portables which is the subject of this initial study so that part of it was already approved as part of the facilities use agreement tonight all that is before you is to approve the initial study under squa thank you uh trustar for asking that question and uh thank you Ro for clarifying I was going to say that I just you

135know reiterate um that the approval of the classrooms has been done um and yes so we are voting on this report so moving on to the vote um I'll go ahead and call your name as I see you on my screen and we'll go ahead and start with trusty Beano did we have a motion already Yes uho motion and Chavez second Okay I uh trusty fam no uh trusty Chavez hi uh vice president kto Y and my myself I um passes thank you so much we'll go ahead and move on to item 123 I think uh Linda you um pulled this item and you're on mute in case you're talking to us I see that month after month there's a lot of expenditures as far as lows go as far as far as Home Depot

136goes I wanted to pull this to say that and also if I could get a meeting with uh Mr Chang and the superintendent and maybe see uh the receipts and why it came to almost $300,000 for one and 9,26 93 cents for the other one on the lows uh so if I could request uh a meeting and see if we can get some dates together because I think it's real excessive since I don't see any construction going on at any of the sites and month after month I see uh big numbers so if you can oblige me with uh sending me dates that work for uh Mr Chang please Dr Bower and um that's it thank you Dr I don't know if there's any um answers that you have as of now um very briefly

137if I may because I know that this has been a concern of trusty Chavez and I welcome her to come and and have this a meeting with us and I just want to remind the board and our public that one of the most difficult and more more the most expensive pieces for our district is to maintain the facilities and in this past month I have been sitting with staff one on once everybody staff knows that and funny that you asked uh trusty Chavez because yesterday I had one of theot guys meeting with me one onone and one of his frustrations and I want to Echo that frustration so that everybody knows is the vandalism that occurs in our schools so when everybody says where are you spending your money I want to remind us that

138one window is $800 and when you break when you break multiple windows multiple weekends or multiple days the tab gets very expensive so I urge our community whoever is listening that if you want to be part of the solution we really need to address this issue and I welcome uh trusty Chavez to have that conversation with you I just want you to know that we are here really securing our facilities and just to give you that sense you know of where these things are coming from so um that's all I wanted to say thank you Mr CA yeah just wanted to add to that um and you know the lows and Home Depot exp this year is a little bit higher than previous year uh you may recall we get a lot of our um

139supplies to reopen the classrooms from Lowe's and um Home Depot for example we purchase our filters from them we purchase our texting glass from them um and so those are the big tiet items that keeps evolving um also cleaning supplies and so um you know it it it has been um higher than in previous years but the majority of the expenditures and and you know you're welcome to take a look at itemized uh receip when you come in but just wanted to at least share with the whole board and also the community that you know um some of the major big big ticket items are related to items that we need to reopen schools thank thank you so much Mr chain um can I get a motion for this item of uh anybody on the

140board um uh motion to approve thank you second okay second by vice president kto first and motion by trusty fam um with that we'll go ahead and open it up for public comment at this time say yes madame president at this time we have no speakers okay I'll give the public a couple seconds do we have any now uh still no speakers okay with that we'll go ahead and take a vote on this item I'll call you as I see on my screen trusty varano trusty Bano vote I uh trusty fam I uh trusty Chavez no vice president Kinto hi and myself I thank you now we'll come back to um item 401 alumrock administrators Association do we have anybody in the audience um from a AA at this time wishing to address the board

141I do see Maria um Martinez I'm welcome Miss Martinez um I saw you and there you are welcome um feel free to unmute yourself and uh give us your report thank you great thank you so much good evening Alam Rock School Board trustees and superintendent bow even though we are only 10 days into June my fellow administrators will agree that June is one of the busiest months of the school year administrators have been busy preparing our schools for summer programs cleaning up campuses collecting materials from students Etc however some of the funnest and most memorable events are done in June as well such as a variety of promotion ceremonies whether done in person or in a car drive-thru manner there were plenty of opportunities to celebrate and honor our wonderful students families and teachers we

142want to congratulate all of our students who are being promoted to the next grade in their educational Journey throughout the year we are proud to have been able to support the students and families alongside our ases providers who were supportive with our carepods on campus teachers who taught in person and online and of course our classified staff who are on the front lines every day ARA wants to thank our part thank all of our partners for the tremendous support that was offered this year speaking of Partners we also want to take a moment to take to thank the San Jose Rotary Club who was able to donate a very very generous grocery gift card to every family at Joseph George Middle School looking on the horizon for next school year we are proud to state

143that adalante 2 will be opening its seventh grade class next year and painter Elementary's Vietnamese dual language program will be expanding to first grade as well so it's great to see our dual language programs in Alam Rock thriving lastly I want to say it has been a pleasure serving as the president for the alumrock administrators Association and I look forward to the work we will continue to do with Dr Ivan Montes principal of San Antonio as our next ARA president thank you thank you Miss Martinez um now do we have anybody from Teamsters wishing to make a report at this time anybody from Teamsters please raise your hand I don't see anyone okay um we'll go ahead and move on if um staff if you can help me look at the list no nobody okay

144we'll move on to uh California School Employees Association CSEA anybody from CA I do see Sharon welcome good evening can you hear me yes oh good evening everybody first thing I want to say congratulations to all the retirees this year not just the CCA retirees but Teamsters in area as well it's a new step I retired about four years ago and the biggest thrill has been to spend tons of time with my grandsons 5 eight and 10 so that's been fun so good luck in whatever you pursue in your journey it's you're it's going to be a ride and secondly on kind of a sadder note as you know in point 11.8 on your is the resolution for classified reduction of positions and even though we know that we understand it's a consolidation of the

145schools that is this is a requirement it's still for the members they're being moved to new schools new new sites layoffs and so forth so it still hurts a little bit even though we understand the reason behind it so um I know it's a difficult decision for the board and the superintendent to have to consolidate and close schools but we also understand the reasoning behind it so with that being said um I just want to say have a great summer everybody and um we'll we'll continue to talk thank you thank you um and I'm not sure if somebody from Team stor was trying to get on um before just want to clarify was somebody trying to talk did you have somebody fromers uh board president I currently do not see anyone okay great thank you

146um so we'll go ahead and move on to alumrock Educators Association area um if you could please raise your hand I know Joselyn was on um yay Joselyn welcome you can unmute yourself at this time thank you good evening again um I know time has gone by so I kind of doubt that Dylan is still here but Dylan if you are still here I I too want to congratulate you on your award I know your Grandpa Tony Alexander and I could hear in his voice how very proud he was is of you and he good reason to be uh I'm sure you have good things awaiting in your life so congratulations and I too would like to congratulate all the retirees of from csca teamsters and the teachers of area thank you for the many

147years of hard work you have put in for the students of alumrock and I wish you the best in in your future when I sat down today to plan out my thoughts for tonight I realized that you really probably didn't want to hear the thoughts that I had outlined truth be told they weren't a very positive or uplifting way to end this incredibly challenging and unique school year therefore I've decided to keep my comments brief and to the point this year has been one of the most difficult I can remember in the 30 plus years in alumrock some of it we had no control over obviously there is no Playbook on how to teach during a pandemic and much of that was a matter of learning on the job however other challenges I believe could

148have been handled differently and possibly avoided Al together regardless I do want to acknowledge every teacher in Alam Rock during the 2021 school year I recently found out that since the county chose to not have the teacher of the year award Alam Rock chose to not hold the traditional event either honestly I've always questioned that event anyway but it's not that's not my point here it is my belief that if there ever was a year to honor a teacher of the year this year would have been the one to do so and every teacher in this District would have been honored to do what you did with what you had to do it with is nothing short of miraculous I admire each of you individually and all of you collectively I would also like to

149express my concern that I think that you as a board may have been misled on the action on the resolution that took place in April regarding the consolidation of schools it was my understanding that you were taking action to consolidate schools with the intent of saving money on administrative costs and with the smoothest transition as possible and to simplify the consolidation of the for the two schools at the sites I believe that area's position has been misunderstood to some of you board members area was never opposed to taking such such action but the way this is playing out is not in line with either intent as you are aware the two Consolidated sites will now have or are you aware that the two Consolidated sites will now have three principles in only two that the

150savings on administrative costs are you also aware that all of the teachers from fiser and Matson were placed on an involuntary excess list rather than being Consolidated into the two new sites without getting into the weeds of this situation please understand that a smooth transition is far from what is happening the next issue that I would like to address with you is that of area going into yet another summer without a settled contract tonight you are scheduled to hear another budget presentation as I've mentioned many times before reading a school budget to me is similar to learning a foreign language and maybe to some of you as well sometimes it helps to have it simplified so here goes as you are aware are you are you aware that the alamro school district will be receiving

151a total of 56 million ion Dollar in onetime money this year I know you've heard different amounts from previous speakers that are close to that but uh this the actual dollar amount was taken right off the school services website School Services is the um organization that informs the school boards so I do believe that you would consider it a reliable source are you also aware that the governor's and anticipated cost of living increase for next year is 5.07% I know that you're aware that Al that area has not had an increase on the salary schedule for two years in a row we understand the idea of declining enrollment however we are not the only District experiencing such but we are the only District that is not given a salary increase to its teachers in for

152two years in a row Actually I don't even think there was another district for one year not let alone two years this is not a fiscal issue this is a priority issue and it's an old issue please ask questions exactly what is that money being budgeted for and how many millions of dollars does it take before you consider the teachers in this District you've heard me mention that we will not be bargaining over the summer uh you've heard other members mention it and it's true and it's not because it's you know it's not because we not only don't get paid for it and that we're not on the time clock but honestly we need a break we bargained all last summer we bargained all year we've been bargaining for as long as I can M

153and have not had a break however that does not uh prevent the district from sending over an offer in writing and I guarantee you that if that is done that we will take a look at it uh however it's highly unlikely if not impossible for us to work out our schedules for this summer to um come up with a day before school starts which you know is to say we get three months during the summer if you really look at the calendar our new teacher Institute begins two months from today um I would like to say or actually respectfully request that as things are beginning to open up which is a great news on all parts um I am expecting that at some point soon probably we will be resuming to having board meetings in

154real life in person um which also is a great thing but my two requests that I hope that you strongly consider is that you will continue allowing and providing a zoom option um I I do believe believe that it's allowed for many more people to stay engaged and involved in what is going on with the district and my second request is and along with a thank you that this past year you um moved the close session toward the end of the agenda and I am hoping that we can continue it being at the um end of the agenda I realize it makes it difficult for the board members and people involved that have to stay but but you have to stay anyway and not everybody else does and so I think in order to provide

155you know allow for the parents to be able to go home and the community and the teachers to go home um it it would be very helpful and very appreciated if you could continue holding the Clos session at the end of the um board agenda and with that I hope that um everyone has a safe and um much needed relaxing summer as much as it can be and um look forward to what the new school year will bring thank you you thank you Joseline uh Dr Bower um I have changed my comments like 90 times since I started and um preparing for this about two weeks to go all the way to right now because this has been quite a roller coaster but I just want to say thank you to all the staff and

156all the families and all the kids because we made it we went through a very difficult time and we came out of it together and I am very happy I know that some of us um had some losses you know and I totally honor that and I'm very sorry about that but I end at the end the alumrock family we were able to move forward we learn how to do distance learning and we were able to feed and provide services for so many families that we're we're going to still keep on doing that over the summer just so that you know I still have families asking are you are you still providing uh food for us and the answer is yes so we don't stop stop we we're not going to stop we're we're here

157to serve you and I'm very proud of each member each staff member each partner each family that makes makes up this fantastic fantastic community that I have the honor to serve I also want to open it and and it's just this is another this is an invitation to help me come up with better services to compete with a competition um there are many many ways where we can really assure that we keep our kids especially the young ones because once they come with us they stay with us the data shows that 85% of the young force that we serve stay in alumrock for good that's a a pretty good record that means families trust us they like our teachers I love what DSA says that said about Miss Herman I love those testimonies because that's

158the kind of caliber of Staff we have in Alam Rock please join me in providing better services to our students so that our families can come and choose Alam Rock and if you have any other idea any other way of making Alan Rock more competitive send me an email let's talk about it thank you Alan Rock have a fantastic summer and we'll see you very soon thank you thank you Dr Bower I'm gonna open it up to my colleagues here um any of the trustees truste wano yes thank you um first and foremost I didn't uh get a chance to do this last month I wanted to do it this month after the fact I want to first of all congratulate all of our students and families for successfully completing this year part particularly those

159who graduated from 8th grade or were promoted um you know that's it's a big milestone in in your lives and and you know it's a step to the Future and to the successes that you'll be having but for now for at least for the time being enjoy that and celebrate your accomplishment to this point um the other thing that I wanted to talk about goes back to actually how um president ATA opened tonight's meeting which is the the violence that occurred in our community and the shooting um that occurred and you know to Echo that first of all obviously condolences um go out to the family and the families that are affected and if you need resources for any issue suicide um counseling whatever if you go on my Facebook page I I put phone

160numbers and websites for any of those resources so if you're an individual a family member anyone who's just feeling like you need some help you can find that there or you can contact me and I can forward that information to you for yourself or someone you may know that's struggling um and along those lines I had a a couple conversations with Dr Bower and I know I appreciate that she has followed up on on some of those things because I know that our district you know throughout the year we we go through and read and approve kind of like our policies with regards to complaints and the process when there's disputes between um disputes or complaints within our employees and our staff here in the district and there's also Union um procedures that that kind

161of facilitate how we try to navigate when we do have disagreements and and I know that this particular instance that we we saw here at VTA was an employee who you know there seemingly had been some friction there had been some maybe dissatisfaction with other employees or with management or things like that and and I don't know whether or not the resources were available to the individual to ideally we we'll never know if it would have made a difference but to at least have something available to try to address those things and and whether it's mediation or c in or whatever it may be to make sure that our our staff are all supported as best we can and in in terms of whether it's mental health or just um conflict resolution amongst peers and

162staff because it all H it happens in the professional world we don't always agree and sometimes we need to work things out and if we don't have things available to our staff and to our our you know Allen Rock family then you know we don't that that leaves people to to their own devices to try to struggle through it on their own and so I kind of I guess I'm requesting um for Dr Bower to to and staff to look into um what systems or structures can we put in place such that when and if we have staff who who have any of these types of issues again whether it's mental health conflict resolution whatever it may be Beyond those processes that already exist for complaints or to go through the um the the processes

163outlined in the contracts if we can look into developing something that that is supportive of of all of our staff and and hopefully is a preventative measure to um you know to things escalating in in any way um so and again I know Dr bow has already kind of started having some of those discussions which I appreciate um but that's I guess the extent of my comments slash request tonight to Dr B and if you have any response at this time um I'd be welcome to hear it or if not you know hopefully we can see something moving forward that's it for me for tonight thank you trusty fam okay uh first of all you know uh following Our Moment of Silence uh for the VTA sh victims I want to express my condolences to

164uh the family the victims and families of the victims uh of that uh Transit workers have played an integral role in you know making sure that those in our community who don't have the means of private transportation can get from one place to another you know from home to work and work come home or uh wherever they need to be and you know to have such an event happen uh it breaks my heart and you know uh uh you know um they are you know truly truly the uh essential workers uh in this pandemic also so I wanted to express my sympathies um you know second of all uh I want to say you know even though I was a midterm midyear pickup you know boy what a what what a time to be on

165a school board to kind you know uh to to basically ride ride the the second half of this pandemic and uh here we are five days away from this state turning green uh you know uh Hope Springs Eternal uh I look forward you know this is a you know as we move into our summer programs and we prepare for yes the return of inperson learning I am you know looking forward to working on with with all the call all my colleagues on the board and the superintendent and her staff to you know make sure that uh we get into 2021 2022 on the right track you know I we've been able to do what I had hoped to set out to do which is we we bailed water and we've made it to land uh

166so you know and I am uh very hopeful that we're seeing the expansion of adalante 2 and uh getting the painter Vietnamese dual language immersion school you know uh out of the gate uh so we're I'm committed to seeing good things come out of Alum Rock uh for next year and last of all just as a a request you know given that we you know we we need to kind of Mark the you know Mark the occasion and celebrate you know the commemorate uh those who have given you know a lot of time in serving our students so uh I would like to request the superintendent you know as as soon as we can to consider a a teacher of the year and Teamster of the year uh ceremony because uh you know uh you

167know I you know uh our you know we've done so for for the classifying employees and you know this is our opportunity to say thank you to uh our teachers and uh as well as the the maintenance workers whove kept this running and uh last of all I I want to express my my deepest gratitude to uh Child Nutrition Services uh you know we are you know even in these times we are providing proudly providing a community meal service this summer and you know I want to you know uh you know uh this is the power of a community Public School District here uh you you won't see this in any of the charter schools we you know when when there's a need in the community where there to serve that need so uh I

168you know again want to express my deepest thanks to the employees of our uh Child Nutrition services for that thank you very much thank you trusty fam any of my other peers would like to say anything trusty Travis yeah first of all I wanted to thank the parents the grandparents the siblings sister brother Uncle friend of these students that helped them out during this year because they needed a lot of assistance and I want to thank all of them um I I did want to um Echo what Joselyn said about continuing and allowing Zoom options because we did get more participants during the year uh because of this and I think that the more that we are open and honest in our Communications with the parents I think um and the staff as well well

169as uh all of the unions and and other members of the community I think that it's best in in our best interest to do so and also uh if we could think about uh if it does help everybody to have the close session at the end of the agenda then maybe we should um you know continue to do so uh and also on one of the things that uh I had seen that they were um providing bus passes for children who were homeless and um and need help with that but I also was talking to Dr Bower yesterday about maybe so that we don't lose so many students if we can do that or or have the ask the county or ask um the city with some help um maybe they can offer it at

170a discounted rate or maybe you can get it for free or maybe um play the whole thing but it still makes sense to be able to bring more students um to the campuses of alen rock um if they take the bus maybe for the older kids and and they also offer it for the parents is what I was seen in the um thing that we're going to be voting on later so maybe we can address that issue I don't know if a committee needs to be formed or or just the superintendent asking the county for that anyways thank you thank you uh board vice president kto would you like to share any words or sure yeah in line with what has been mentioned about um the tragedy that took place at the VTA Light Rail

171service yard um definitely is uh um some that that um it's uh more significant due to the fact that it's part of the labor family at local 265 part of South B labor Council I happen to be the member delegate of the American Federation of teachers and so it's uh you know it hits closer to home these folks were going to a to their union meeting and uh and and they just expected to go and take care of business move on and and continue on to provide a service that is essential to to those um who use public transportation in our County and so um you know prayers with uh the family the families and all those affected um I wanted to uh thank uh our our district because of the summer learning opportunity um

172I know we received a very extensive report last meeting but as we've been seeing uh those uh learning opportun unities uh that other districts have and we compare contrast we see the very very robust opport uh portfolio of Summer learning opportunities we're providing here in rock and so thank I want to thank the administration uh the uh faculty the teachers uh the all the classified staff everybody who's come together uh to make sure that this moves forward and that our children have uh those opportunities to catch up or to to at the very least try to mitigate some of that um unfortunate learning loss that took place over the course of uh this having a Shure in place so um very appreciative of of everything that's gone into providing that summer those summer learning opportunity

173here in Alam Rock um I also uh wanted to report out from our small schools and Innovation committee we met on June 1st and had a good conversation about uh the need to go ahead and start showcasing highlighting uh those folks that have gone above and beyond in terms of our alumni uh we see that other districts have foundations have organizations that put together uh events that showcase what are um what what their what alumni have done or what individuals uh the work that individuals have done to move the district forward and so we had a very robust conversation uh around that and I'm looking forward to seeing that recommendation move forward uh to the full board at the committee level uh we went ahead and uh took a page out of out of um

174various organizations that tend to take a look at different sectors of the community and uh we recommended uh that um we from the nonprofit sector Jolie Smith uh be uh recognized uh because of you know she runs a massive organization that has a huge profound effect on children's lives in Santa Clara County and she happens to be in Al Rock alumni something that not a lot of people know and so I think that's important to go ahead and showcase those individuals who are products of our district who gone out there and done uh great things like running uh first five s count it's huge massive organization that does a humongous amount of work for our children so I think it's in line with what we've done um we've also taken a look at other sectors

175so while we have the nonprofit then the idea was to go ahead and recognized individuals who are alumni of alen rock and the sector that was selected was business um the uh the honoraries that were the committee moveed forward were the Calon family in particular Ario and joseon who um are products of hover as well as Fisher Middle School um the family has decided to go ahead and find its roots in alen rock and Double Down by establishing businesses that go ahead and generate tax revenue that then in turn goes back to continue to support Al Allen Rock School District so um those are things that we want to recognize as a committee so it was a very robust discussion um and there was talk about other other folks but uh this was considered a

176good compromise and the idea was that it's just the beginning and we're looking forward to seeing how this uh you know the idea is that we have to start that we wanted to start somewhere and uh this is sounds like a good start and so you'll be getting uh the staff will be getting the minutes and they can go ahead and be published and the recommendation will move forward from the committee to the full board so um lastly I want to close off with congratulation all students who are promoted um my family we had the excitement that comes along with the end of the school year as well as that extra special opportunity that that extra special excitement around promotion time because my daughter was promoted and so um it was very very exciting to

177see um everybody at uh the school so pumped up and excited the teachers out there um uh waving goodbye to the kids at the end of the school year uh the kids going you know crazy as they're honking in their little driveby par parade and stuff like that so very very exciting time thank you to all to made uh this year possible um allow our students to continue to learn even under very difficult circumstances thank you board vice president um for myself uh I also want to acknowledge uh an end to a very tough year um probably the toughest year in school um at least within the 100 years um I think the last pandemic uh kto was talking about 1918 um so this was the first full year during a pandemic and um just

178want to acknowledge everybody from the teachers to the principles uh Dr Bower um I know we've already said it but just acknowledge um all the extras and all the things that had to be put on hold and um the priorities I needed to shift in order to ensure that our children um we're safe we're learning um you know we're not falling behind I know we're going to go over some test scores and um I'm happy to see you know the outcomes of of our children even during this tough year um and I mostly want to um acknowledge our children our students uh because as as adults you know as parents or teachers administrators you know we could take our time out we could take a walk we can go hik we can say I'll be

179back I need a day off but our children just go and go and go I know that if my daughter were to say I'm out of here I need a break I'd be like wait a second you know you're not g to just leave like that and so our children Just Go With It day in day out wake up don't have the choice at least not mine to go to school you know they got to go keep rolling with what's coming um and so children you know thank you for being so so resilient um for being you know so a brace I know our 12 years 12 year olds are now being asked to get vaccinated I know that you know that's scary I've had my conversations with my 12-year-old you know and and and

180transitioning um for our children as to what you know what's to come and am I next um so thank you children thank you for being patient with us um as your parents as adults as teachers um and trusting Us in um getting through this so now that uh we're hopefully approaching this June 15th magical date that we're all so patiently waiting for um you know I'm happy that we're reopening we're um having you know some of our committees that were put on pause you know it's great to hear some of the ideas that vice president GTO you know and um uh trusty Beano have been talking about you know um we're getting back back to business back to some of the things that we put put on pause and with that um I look forward

181to you know checking with trusty Beano and our calendar ERS to sit down um for that safety and wellness committee um and letting the public know you know so that you're all invited whoever is interested in sitting down with that um thank you uh trusty Viano for bringing up that idea you know I think um that along with a couple of others that I also mentioned um to Dr Bower you know the fact that we don't really have although we're doing a lot of a social emotional learning work in our schools we still haven't put it into policy and so looking forward to doing some of that work so that when our board when you know those of us are here are long gone that the work will continue regardless of um of who's uh

182leading and also I want to acknowledge the summer programs you know um I although Joselyn did mention that you know some of the points that she was making we weren't going to agree in I actually think the opposite you know I agree on a lot of the points she made um and you know especially uh acknowledging that our teachers are doing hard work and that they should be recognized so I agree with Mr fam with trusty fam that we should have a day to acknowledge all of our teachers and then also um you know when she talked about you know this welld deserved break you know she talks about she talked about you know having a Break um and not bargaining right and so honoring that like we do need a break you know those

183of us who've been going so our teachers need that break so if you're taking a break welld deserved you know you should rela relax um and those of you that are be going to be working in Su summer programs thank you um and also I want to thank staff for bringing those summer programs to us and my peers the other Trustees for approving um and you know voting to have those summer programs to pay for those summer summer programs um I know there was questions about where some of that money is going to and that was a big you know chunk of our of our monies um our summer programs to continue serving our children of our community um you know I hear some of our neighboring school districts um are charging for theirs and

184we're not you know and so um very important for our families you know um and I know our families count on that um and last but not least you know I want to highlight you know I talked about the end of this pandemic and the vaccines um you know our community still not out of you know we're still not in the green you know uh I know that as a county we keep hearing we're at I think the last number was 77.8% of our entire County that's been vaccinated which is great you know but when we break down the numbers our communities here are the lowest vaccinated um still highest numbers with covid so we're still not out um and so when we talk about coming back you know um as one of the leaders

185here I'm going to ensure that we don't just come back to you know how we used to be packed here in the boardroom right um but that slowly as uh Joselyn requested right that we offer the virtual that we offer that we have the number of people here that's safe enough to hold these meetings um so I look forward to definitely um continuing to support the virtual until otherwise you know we're able to to all be in the clear here in Alam Rock um so yeah I look forward to um supporting some of the items that are coming you know in in place I know uh trusty uh fam mentioned our child nutrition services staff you know which sometimes uses their own vehicles to get lunches to you know may ensure that our children and

186our families have um food and so um all that you know as trustees we get to um you know honor as well you know along with the teachers and um we get to see the whole umbrella picture and ensure that um the money continues to go in the right places um you know and doing our best you know I hear the teachers um and I'm with you um we all deserve you know uh a cost of living and to be able to live comfortably um and you know in in know that as your board president and seeing our numbers and seeing our budget you know I will continue and and I can assure you that my peers are as well um to uh push for um a raise that will will be aligned with what

187we can afford and so with that um I'll go ahead and end my comment and we'll go ahead and move to item 501 but before starting I do want to say um if a after 503 um we can break have a bio break a five minute bio break so just to let you all know if you can hang on a little longer hang on otherwise you know take care of yourselves as you have to um so with that we'll go on to item 501 Dr Bower um do we have somebody presenting on this item yes madame president I am going to ask uh Sandra you will be presenting on this thank you so much thank you Miss Garcia welcome good evening let me share my presentation here okay uh good evening uh board president uh

188Corina rala superintendent Dr Bower board members in the community uh my name is Sandra Garcia and in my role as director of state and federal programs I'm prepared to share information for tonight's public hearing as part of our lcap approval process um first I'd like to to share um the adoption requirements um moving forward um from this meeting and then at our special board meeting and the requirements uh so for this meeting we are um I'm sorry to adopt an lcap we have to hold at least one public hearing uh to solicit recommendations and comments from the public um at the same meeting we will hear uh the proposed Alia budget and budget over parents has been um presented and then at a subsequent meeting which is at a special board meeting that we have

189set for June 24th uh the governing board will adopt the um annual update from 20221 the 2021 22 lcap um and then the lcap federal addendum the Alia budget and the budget overview for parents they're all part of the same package so it's done in two meetings um I'm sharing the timeline with you of the work we've done this year in terms of the development of the elap and um it's been a a process starting uh in pretty much in February we did a lot of the the prep work through now and we are at the public hearing um stage and again um hopefully approving the lcap on June 24th then we will submit it to the County Office of Ed by July 1st I did have some board updates I just wanted to have

190a slide to share with you the work that we that I did share with you um beginning in March um the stakeholder process and how we gathered input from our stakeholders I did share some of the trends and findings and um now I'll be sharing the lcap draft and some of the annual um measurable outcome information these are the requirements uh for the lcap and what's included in the lcap um when we submit um it is the annual update from the previous year and since we didn't have an l cap last year it'll be from the past two years it'll be from 201920 l cap and then the 2021 uh learning continuity plan um then we we within that annual update are results of the annual annual measurable outcomes and then uh we have the

191uh lcap that we are proposing for next school year um with the four lcap goals the actions and services including the budget allocation and a a budget overview for parents um the goals for the 2021 uh 2024 elap um are the following and they will focus on the instructional program for students um annual progress for English Learners uh support provided to students families uh to provide a a positive learning environment and then strengthening relationships and engagement by all stakeholders so here's a recap of the trends gathered from various uh stakeholders across the district um a few of note are of high interest um in the following areas so uh some of the the most um commented on and um of high interest to all stakeholders were the maintenance of and I've heard this um this

192evening as well some of these mentioned are the maintenance of some of the practices um Andor platforms that were introduced during distance learning um some of the online student platforms that were very useful in tracking student progress and communicating with parents um the block of time to focus on social emotional learning was another one that U was mentioned quite often um number two was the increas in counseling services a lot of interest in making sure that we are providing those services for students as they return um to inperson um classes and some of the the support that they may need to make that transition back number three is the our the training opportunities for parents um parents uh were very uh grateful and um felt that a lot of the trainings we offered this year

193um were very useful in helping them um navigate um distance learning with their children so some that they've mentioned um many times are the student platforms trainings on the student platforms um some trainings and strategies that were shared um mental health kinds of um ideas and trainings that were offered and then the tech related because you know being on on um virtual learning everyone had to learn how to to um use the the new technology uh involved in that and then number four um and I heard this mentioned a few times this evening is the increased accessibility for meetings so you know a lot of interest in continuing the virtual option for meetings um once we are able to um return back to in-person meetings so that more families and parents have uh our access

194to the meetings as well as interpretation services that we provided this year in um English on Spanish and Vietnamese so now what I'm going to do is I'm going to um share the four goals and um I've done two things uh within the slide I've shared highlights from the previous lcap and learning continuity plan and then um some proposed actions and services for um the new out c um so I'll begin with um celebrating some of the accomplishments from uh the 201920 lcap and 2020 21 learning continuity plan for goal one um so in terms of goal one and some of this data is a little outdated but because we didn't have um ESC testing last year this is the most recent um State data that we have to share but it's still valid and

195important to to note uh we did have a seven-point increase in performance in English language arts and a Sixpoint increase in performance in mathematics for our students with disabilities and we're very proud of that because we did focus on um really um honing in on what what we could do to um help these students increase in those areas and so we did see um the increase on the 2019 aspect for those students our homeless students uh were in the Red performance level uh and they moved into the yellow which is two uh performance levels up um in ela and math and then our African-American student uh uh subgroup move from the Red performance level to the yellow in math and that's again that's two levels uh performance levels last year we were able to provide

196one toone devices for our students during school closures and um one of the the um highlights that I I I am most proud of is that even during school closures we were able to um provide services for students in person students that um needed the support the most you know some of our foster youths some of our our unhoused students some of our uh English Learners and just students that were having difficulty at home accessing um uh reliable internet service or maybe they didn't have somebody at home who could really help them uh with and support them with their classes and getting on their um virtual classes but we were able to have 52 care pods districtwide and we served uh approximately 534 students within those care pods um special ed was also able to

197operate a few care pods uh for their autism um classes so that's another win for for our community um and of course we rolled out a variety of student platforms and apps that helped for our distance learning program so moving into our new alcap um some of the actions and services for proposed for the upcoming school year include those that support a comprehensive instructional program such as support for new teachers uh extended services for our TK um uh Kinder students with the support of our partner agencies a continu continu continuation of student platforms used during distance learning which um we've heard a a lot of families hoping that we're going to continue and teachers hoping that we're going to continue with some of the the platforms that we were able to use this year and

198then of course the professional development that comes along with um the the learning of all of these platforms and new programs that we've used with our students and this is just a general snapshot so for goal number two which is um a support of our English Learners and their language development I will share the high some of the highlights first and um some that were you know I want to point out most is the uh 5.5 Point increase in our English language arts ESC results for our English Learners um and then in math uh they were able to maintain their performance level on the 2019 espc assessments uh according to the 2019 dashboard 41.2% of our Els are making progress towards proficiency which is comparable to the state average um and we were also last

199year one of the highlights was that we were able to offer some additional support to our newcomers and long-term English Learners um uh in addition addition to what was being provided in the classroom um during distance learning so moving into um the the um this next year's out cap um some of the actions and services proposed are uh deepening the understanding of strategies that best support our English Learners through PD um and also some additional support programs during the school year and summer programs language support programs that provide additional support for our lower grade students um so that they can um have a good foundation in their second language and then more awareness and support for our Pathway to biliteracy award you know a lot of people don't um understand the importance of uh serving

200our English Learners also through a quality dual language program and how important it is to to um to provide those kinds of opportunities for English Learners to um learn English as well as maintain their their first language so goal three um is uh providing that inclusive and caring environment so students feel safe and welcomed um and some of the highlights in this area from the previous lcap and learning continuity plan are um last year we established some some committees and some um support that you know will last you know in during this next year uh but more importantly during the school closures our edtech mentoring program supported teachers at varying levels um you know we all know and and I know that I experien the same thing um when we went into distance learning is

201just having to learn a lot a lot more about technology and how to have meetings uh virtually and how to share presentations and just a lot of basic things but also um being in the classroom and and having to use technology and depend on technology to to teach students so uh of course there were varying levels of of uh proficiency and this edtech mentoring program really supported the teachers in that we also were able to form an seal committee where teachers counselors community lisons and district office administrators um uh created a scope and sequence uh for social emotional learning uh resources that uh were housed on our district website and um were accessible to parents teachers and Educators to to use with students um we had approximately um um 400 students that were served just

202through our counselor intern program um so of course we have our school counselors and then we have our interns and just with our interns we're able to serve approximately 400 students which is um great news for for our families that we're able to get that support um I know this was mentioned earlier as well but I want to point it out one more time the wonderful job done by our CNS department and being able to um feed our our students and our families and anyone under the age of 18 uh during uh school closures um we served over 3.5 million meals since March 16th of 2020 um and as Dr Bower mentioned earlier we're going to continue to do that throughout this summer and um make sure that our families have um food to eat

203this summer um something else I wanted to mention and I'm not sure everyone's aware of this but um our uh CNS Department also uh developed a program called mobile meals for families who didn't have transportation and weren't able to make it to the the designated School sites to pick up meals so some of the our very our neediest families uh were able to be served through this mobile Mills program and that was about 200 of our um alum students that benefited from this program so I wanted to make sure that I mentioned that as well so moving forward into this new lcap um uh we have heard loud and clear the the need for more mental health and social emotional learning in our district and that is written into the new elcap um the alignment

204of positive School culture uh strategies um across schools uh the cont continuity of our music vappa and um after school sports programs um you know uh as long as we're able to to to provide those in person and then we we plan to continue those programs and then also um adding on some trauma informed practices training um we've been hearing from many families and teachers the the need to really learn um how to to support students as they return back to school and knowing um that so many things happened during um this pandemic that you know our kids are going to really need um additional kinds of support that might not be PR prepared to give them um without this type of training so looking forward to providing that training for for folks and then

205the last goal is um goal four which is um the involvement and engagement of our stakeholders and then really fostering those relationships with them and and deepening uh the kind of relationship and and the way we um we support support our families as well um through this school so some of the highlights um for the previous um lcap in learning continuity plan um that you know we have been able to um continue the interpretation support um for families and this year really extend and I was mentioning to another group a few days back how um we've been trying to reach out to the Vietnamese Community for many years and get them involved in our lcap development and some of our meetings and input sessions and I have to say that I was really impressed this

206year um for our two input sessions that we have had we had a breakout room for just Vietnamese um speakers U and we had an interpreter and we had uh you know about 20 in each of those um breakout rooms and it was just great to see uh the Vietnamese Community involved in those meetings and so of course we want to continue to provide that um access for them in you know language that they understand um parents Square really um made things um you know opened communication up for uh our families and schools in a way that um you know was very effective and um parents really appreciated that uh so we want to continue with that as well um the commun leison were able to offer some parent workshops um on the various um

207communication and student platforms and then Our IT department on offered additional technical support for our families after hours and on weekends so those are definitely some of the highlights that supported go four in the previous years and then moving forward as I said you know just continuing with some of these really important and necessary um supports for our families so that they can be involved in various ways in our um meetings and in their child's education so we want to continue with um uh increased training for them in accessibility support in the form of interpretation services and virtual options as as someone mentioned earlier as well so um the next steps um the first next step and hopefully all of um our trustees um uh received the copy of the um the documents in a

208little booklet um our first next step is to clean things up make sure you know things are matching uh working with the county of office of Ed to um clean things up make sure that all the numbers Jive and um that we're on the right track which so far things are looking really good and then present um a final copy to the board for adoption on June 24th once it is adopted on June 24th then we will submit it um to the Santa Clair County Office of V for approval thank you thank you Mrs Garcia um and I just want to um remind us that we are going to be focusing on just a presentation here I know we have um item 502 and 503 um on 502 we'll focus on the entire plan so

209just want to remind us um so it if I um I guess at this point um I'll go ahead and open it up for um any questions or comments from the board it's not on for approval I see trano yes thank you very much uh as always Andra thank you for the report uh um I I think it's very important uh the Highlight sections as I you know myself and a few of us have continued to mention that we want the public to be aware of the things that are going right in our district in spite of things that get put out there we have the facts for the most part in our favor as I always say there's always room for improvement but we have a lot of stuff in our favor and it's

210important to to get that stuff out there along those same lines I would love to also see in these reports or any reports that we get not necessarily lcap but just in general um it's important I think for the board to not only see the highlights but also sections that might be things like challenges or ongoing work or gaps just so we know kind of not only what all the excellent stuff is that's going on but where we also need to be thinking as board members in terms of like what's upcoming what do we need to direct some of our thoughts and energies to so that being said I do appreciate the um I'd love to see that but I appreciate seeing the highlights for sure because that's important that we get that out there

211I did have a couple of questions um that I think Dr Bower for the most part cleared up in our 101 discussions but I just wanted to ask um just very briefly so on the page that says that's the heading is Trends findings all stakeholders that's one of the first slides um under goal three the the very first kind of bullet point the need for more um maintenance support um that that first bullet there my question is um are we is this is this one here because we're anticipating our need to have expenditures for covid to to be through 2024 because I believe the LC cap here covers 212 through 24 right and so um and I know Dr bar cleared up that every year we have the opportunity to adapt and modify but I'm

212a just wondering if that one is there because we anticipate three years out to still potentially be having to have expenditures for covid um safety and then tied to that um you know we have received some one-time monies for covid related safety um you know all the things we need to get for covid and so how do those one-time expenditures and onetime monies that we've received how does it kind of fit in with these lcap um dollars that we have highlighted here if that makes sense so I'll answer and then um if Mr changen wants to jump in on the on the um covid funds but basically the trends and findings are that just that the trends that we see um once we summarize um the information from all of the forums and the input

213sessions and so that's a topic that did come up and you know some of these sessions started back in the beginning of March so you know we were really like heavy in the the the I believe we're still in the red tier back then and so that was like top of mine for a lot of people um and of course it's still important but it's not something that necessarily would be covered by through the lcap or through lcap funds because lcap funds are more to support students in in academic achievement and progress and those what those kinds of supports but yes we did receive uh covid funding and I know that um a lot of those supports are funded through those one-time monies okay and we have plenty of plenty of PPE plenty of you

214know things that were purchased uh to make the schools safe and even during the carepods you know the sneeze guards and the the gloves and the masks and the extra sanitizers and sanitizing stations and things like that that were purchased okay so then that's mo more than anything that's just they highlighting the need that that was identified Outreach okay thank you for that and then the other second question is um on that same page under gold number one the the the last bullet point and I have mine super small in my notes Here let me see if I can make it bigger it's the one that says um consider other Pathways for students such as CTE it's that the last bullet point on that same page under goal one yeah so on the very next

215page goal one um in the white box of proposed actions and services for goal one again I think Dr clear this up I just wanted to confirm so if one of the goals is that item consider other Pathways for students I'm assuming that that goal is tied to the proposed action of Extended Learning opportunity school year and summer is that where the um Career and Technical Ed fit into the proposed actions or is there somewhere else where it I I'm I'm not sure if I'm making my question clear one one of the okay or if not if that's not covered in Extended Learning do we need to make another do we need to have another bullet point that reflects Career and Technical Ed you know that's something that's important to me and we certainly have

216heard the community also voice that so I just want to make sure that that goal is tied concretely as as concretely as possible to a proposed action or service so um yes I understand your question and and again you know the trends and findings um don't necessarily mean that we'll be able to do everything that are in the trends and findings but definitely there are things that we consider and can explore one of the things I did in goal one is I did add um it used to read that it was for college um uh Readiness I did add College and Career Readiness and I felt that that gave us an opportunity to um flesh things out a bit more and kind of have a discussion around that I don't want to stick something into

217a plan if we haven't thought it out and even had time to really have a discussion about it um but it's definitely something that I know um that that there was some interest in uh and it did become a trend because there was enough interest in it so um it can be done through Extended Learning opportunities I know know that um Even in our after school programs you know with one of our providers they do some um um apprenticeships with different kinds of um um um uh what do you think different time uh exploring different types of careers and so there are different areas where we can fit it in um but I didn't necessarily put it in one specific um bullet point if that makes sense okay yeah something it is in there in

218the goal and it is something that we can continue to um look into and explore how we can do that okay thank you and I appreciate that you said fleshed out and not flushed out as is a common saying as a bit of a language nerd I appreciate those little things so thank you thank you I'm on mute thank you trusty Chavez oh yes I too had a a tech question um on the technical education how many uh hours were provided when you did do the increased Technology support for the learning and how many hours do you uh anticipate will be needed uh for for the support in the ongoing year uh and thank you very much Sandra for the presentation very clear and concise thank you um are you speaking of the extended hours

219in the IT department you're you're on mute that and also the teachers uh took some tech training and how many hours were they given and are they going to be giving more train given more training seeing that not all of them grasped it uh could you tell me how many hours there were and how many hours in the future will be given for them and for parents and for students who didn't grasp it thank you yeah I don't have the exact number of the hours of training but I can get that I can I'll make a note for myself and I can share that with you definitely uh training will continue um we know that just like students and children we don't learn things and in one training and you need to continue uh training

220and also at varying levels so that will continue um but I will get you the information on um how much training was offered to teachers thank you thank you um any other questions or comments from Miss Garcia um okay uh we'll go ahead and open it up for public comment at this time Jose can you help us out yes Bo president at this time we have two speakers our first speaker is uh from U miss daa you have two minutes please unmute yourself when you begin speaking the timer will begin good evening members of the board my name is Lisa Gonzalez I am a parent um and a community organizer first of all I want to say thank you to Sandra and I apologize I'm a um my kid is screaming on the background um

221so first of all I want to say thank you to Sandra I know how much of of work this is I've been in the forums as well and I am part of the elcap subc committee however um as part of the committee I do not have every single answer and I know s that doesn't either so um I would like to appla First mental health and social emotional Taking Care on this piece is a really really important issue especially now that our kids are going to anxiety depression and we have some loss due to suicide in our communities I also want to acknowledge that um that we keep on Research Justice our um ethnic studies committees and racial Equity but I mainly want to um to say thank you for the sharing meals for our

222students as a child that had a single mom of three kids we I know what hunger means when you're little and knowing that you might not have nothing to eat the next day however I do want to ask how were these family chosen if there was an application um if this could continue for the rest of the families for next year as well and also um if we could send it to more families because I know our district we have around 82% of lowincome students that means um a lot of people a lot of our students go hungry right so let's share those opportunities around I didn't know about those opportunities so that's why I'm asking how do you guys did it and can we continue provided for our families thank you and have a

223really good evening thank you miss ilsa our next speaker is Miss Sandra Riva miss rera you have two minutes please unmute yourself when you begin speaking the timer will begin hello I just want to say thank you um as a teacher who has a name like Sandra Riva um Rivera was a married name and my husband was actually my ex-husband was Guam Ian and so I do not speak Spanish and I have tried many times I'm getting better at it um but I still am not fluent and so I am very happy to see in the lcap that the application of parents square is still in there it gives me an instant way to communicate with parents that automatically translates it in both English and Vietnamese and so it makes it so that I can

224communicate with the parents in the community and feel comfortable communicating back because our messages get translated per our um own personal input on our profiles and so thank you for um keeping that in and putting it through for next year I believe that that is something that is very um needed in our community and it will be a huge asset so thank you thank you for your comments Miss Riva our next speaker is Miss Veronica Amador Miss Amador you have two minutes please unmute yourself when you begin speaking the timer will begin great thank you and I also want to thank Sandra um because during the lcap capturing uh there was um you know the breakout rooms were really great having not just uh her staff but really principles and having other people um support

225in that that was amazing um and capturing and having a a dialogue right they were they were listening and I really F felt hurt and felt like my comments were being put through um and I do see some of that reflection into the lcap I also would that want to make sure um that I want to think about continuing with the mental health support for our students and the advocacy um that we have put into that so thank you as well um but I do also have other questions and as an UA parent I know that that is something that we are um going to continue with this conversation um and we will continue to provide our feedback so I'm looking forward for that um and looking forward for that collaboration with more parents and

226continuing to advance um all the programs that we currently have to support um all of our families especially our families who are most and many of the times Left Behind um thank you thank you Miss Board president at this time we have no more speakers okay thank you uh thank you so much Sandra for your hard work um I know you know pre pandemic and getting parents and going to the forums you know and then in pandemic getting creative um thank you for adjusting and moving with the times and ensuring that um we have engaged Community you know all the stakeholders and including our parents um so thank you for your leadership and making sure that you know this is done and that you update us and that we move forward uh with the deadlines

228concerns seeing No Hands we'll go ahead and uh move on to item 503 and at this time not yet thank you Linda not yet I'm gonna close it soon though I know we're all excited to move forward so now on item 503 uh I'm going to close the public hearing for the local control and accountability plan Al all right so we'll take a five minute bio break at this time so we'll see you all actually this take six minutes 912 um so six minutes from now um see you back here at 18 did I do my math right all right see you then all right who's back Who's Back show your face I see trusty Chavez all right we have Corum I'm sure trusty fam and are returning there you are um all right it's

2299:18 um do we call the meeting back to order just a break and we're good to continue call the meeting back to order call the meeting back to order at 9:18 PM all right so we're moving on to 504 staff presentation uh Dr Bower I'm gonna go ahead and uh um hand this over to you for the budget I'm assuming Mr Chang but I don't want to make assumptions Mr Ching welcome back Mr Ching thank you m M Madam president and good evening um members of the board um commun of alrock my name is KOB Chang actually let me put the presentation up my best okay can everyone see what the screen yes I can thank you thank you um good evening everyone this my name is CER Chang um I'm the assistant superintendent of

230uh business service and tonight I'll be presenting the 2122 proposed budget um and with that um some of that will be covering um our key assumptions um the general fund multi-year projection um and the state reserves um the first assumptions we'll be going over um are enrollment projections um some of you are pretty familiar with this uh graph um this was a result of an enrollement projection study that we did um early this year um so this is the most recent information that we have going forward uh we will be uh recalibrating in the fall um once um school starts and we have Warm Bodies in our seat so um based on that we'll be making adjustments accordingly um the next set of assumptions are Revenue will'll start with um state revenue and the the

231bulk of a Reven from lcff um and so with that um for the district's lcff in year 2021 uh 22 um it will be based on the greater of current or 201920 p28 and the cola for that year is 5.07 uh for year 2223 um it will be based on the greater of current or prior year data or p288 um the cola for that year is 2.48 2324 um lcff will be based on a greater of current or prior year P2 and the col for that year is 3.11 um for AP aptitude school um our conversion Charter Schools um Charter Schools do not have the benefit of Prior year protection ter using the greater um Ada for current or or last year um so all their calculation will be based on current year um however

232the cola is the same um for us so for year 2122 5.07 for year 2223 2.48 uh year 2324 um 111 um other state revenue consists of special ed um special ed rate will be um increased from $625 uh to approximately $650 per um unlike lcff uh special at Cola um is only 4.05 um state bevenue is the imperson grant uh you may recall that uh this grant was made available to us in this in this bring um when we brought our student back in person and um that amount is approximately $3.1 million um and then the other piece of the state revenue is the expanded learning Opportunity Grant uh you may recall also that uh the board approved the spending plan for this grant um back in May um and the total amount of

233this grant is $68 million um in terms of local Revenue partial tax is set to expire starting in in in fiscal year 2223 and there uh we will be removing um approximately $4.5 million um starting in year 23 20 yeah 22 23 um so while it's it's been beneficial for us to receive all these um one-time funds and also ongoing Cola um there's a potential that we'll be losing um approximately $4.5 million every year year of ongoing Revenue um in terms of federal revenue and the biggest part are the Esser monies um as you may recall there are three rounds of Esser so one which is not included in here because um we're using those funds to pay for this year's expenses uh that's why they're not included in this in this chart because this

234chart is for next year's budget um s to estimate is a is approximately $10 million um that will be reflected in year uh 2122 and then eser 3 um we're estimating uh of approximately 22.4 million which will be reflected uh in year 2223 um different from eser one and S 2 eser 3 has a requirement uh where we have to set or districts have to set aside 20% of those funds uh towards learning loss and then the remaining 80% uh will be used for for for broad usage um this chart shows kind of details of lcf lcff um if you can see on the first row um the funded Cola for year 21227 um 2223 is 2.48 um and in year 2324 is 3.11 um so in year 2122 total lcff entitlement including the district

235and aptitude um is approximately uh 102.7 million million dollar um in year 2223 um projected oops projected lcff funding is approximately 9 97.5 and then 2324 total projected lcff funding is approximately 95.7 million um one I want to point out important thing I want to point out is that um as you can see in the first row even though uh with an increase in colas for all those years you'll see that total lcff funding continues to decline andain due to um declining enrollment um if you compare year 2122 to year 2223 you'll see um uh a drop of about $5 million um and if you compare year 2122 to year 23 24 um you'll see drop of about $7 million so just in the two years alone uh due to declining enrollment we're projecting to

236lose approximately $12 million in lcf lcf funding on the expenditure side um we'll start off with the Cal Pur rate um and Cal per is the uh pension program for uh classified staff and for year 202 that pension rate is 22.9 uh um in 2223 it goes up to 26.1 and then in year 2324 um it continues to go up to 2 continues to go up and that rate is 27.1 um the next piece is the cow STS rate and these are the pension program for certificated staff mainly certificated staff and that rate for year 2122 is 16.92% and then in year 23 24 stays the same at 19.10 um the biggest jump we've seen this year was the um unemployment insurance um that rate increased from less than um by half percent to um

2371.23% so that's a significant increase um in employees burden um that the district would have to Born um step and column um continue the increases for all three years um contribution for special a programs um also continue increases um in out years um the district is required to maintain a 3% contribution uh to rouin restricted maintenance account um for all three years um in 2 um in 2223 the district is projecting to reduce uh 15 certificated FTE at 85,000 uh for average salaries to align with the Clin enrollement and then moving forward to year 2324 uh there's a reduction of 10 certificated FTE um at 85,000 um per uh average salaries and again that's is to align with the cining enrollment um one thing that's noteworthy is that the district has not settled um with

238all bargaining units for fiscal year 2122 and then lastly on this page um you will see that um in the unrestricted general fund later presented to you um there will be a transfer of approximately $17.96 million from the unrestricted general fund to the restricted general fund um to utilize S3 fund um in year 2223 so with that um this is the unrestricted general fund um as you can see here that uh the district is Project projecting to have a beginning balance of approximately $14.2 million um the district is also projecting um a total net revenue after contribution to special Le and routine maintenance um of approximately 87.2 million uh for expenditures um the district is projecting um to spend 82.7 million and um incur a um operating Surplus uh for four uh 4.5 um the

239caveat with this operating Surplus is that it's built on um the usage of onetime money so remember back uh in the previous slides where we said that um we are incorporating $10 million of Esser fund um in year 2122 if you remove that onetime fund um in year 2122 um the Surplus would not be a surplus it would actually be a deficit an operating deficit of about 5.7 $5.5 million um so because of the one-time fund um we were able to generate an operating Surplus and add to our fund balance um to to the tune of about $18.8 million for year 2223 um the the district is projecting to start the year with 18.8 and have a total net revenue um after contribution to special ed and routine maintenance ofer profit me 7 76.8 million

240uh on the expenditure um on on the expenditure um part um the districts will is projecting to spend 72.2 um in expenditures um I do want to highlight that um the 72.2 is net of the 17.96% three Fund in the restricted fund general fund um so in 2223 with the onetime funding um the district is is projecting to have an operating surplus of 4.5 however if you remove um the one-time fund for eser 3 um the districts would actually have a operating deficit of approximately $13.4 million um but because of the one-time money uh it's able to keep the districts afloat and also add to the ending fund balance for that particular year um to the tune of $23.3 million for 2324 uh the district is projecting to uh have a beginning balance of about

241233 million um with a with a total net revenue um after contribution to special ed and routine maintenance um of approximately $ 74.4 million um in terms of expenditures the district is projecting to spend um approximately $ 89.9 million um and if you look at the um role that says Surplus and deficit you'll see that in this year um because of the expiration of all the one-time funding um this is the the $15.4 million in deficit spending um is is the true structural deficit um that essentially has been masked uh because of onetime funding uh that we were able to incorporate in year 22 2122 and 2223 um so at the end of this three-year projection you'll see that um the beginning balance for year 2223 is at 23.3 but if you see the ending

242balance it drops down to $7.8 million on the restricted side um the district is projecting um a total revenue including contribution from the unrestricted general fund for special ed and rotate maintenance a total revenue of approximately $51.1 million uh with a total expenditure of 51.1 uh with the zero anying fund balance um year 2223 the district is rejecting um a total of 63.5 uh which includes a contribution from the unrestricted general fund um for special ed and routine maintenance um in addition to that um for the expend expenditure side uh the district is projecting to spend $ 63.5 million and then in year 2324 um the district is projecting to spend or to uh to to have $4 41.2 million in Revenue um and also projecting a total expenditures of 42 41.2 um in total

243expenditure in in the restricted general fund um this slide shows you um as a as a condition of budget approval from the county um every district has to present um a statement of Reserve that shows um the amount above um The Reserve requirement for every District so we'll start with the year 2122 with year 2122 where the district is projecting to end the year with $18.8 million um the 3% requirement equates a little over to $4 million um and which leaves a balance of about $4.7 million above the 3% requirement um and it also requires us to identify the needs of what that um the the amount over the 3% requirement so for the district itself um as I mentioned earlier with all the onetime funds um is masking up um the structural deficit that

244we're Curr we're going through right now um in our budget and so uh with the balance itself um we're planning on using it to mitigate the structural deficit uh when one-time funds are exhausted for year 2223 um the district is projecting to end at 23.3 million uh the 3% requirement for us is about 3.4 um which leaves a balance of 19.9 and again this balance will be to to mitigate um structural on on current an ongoing structural deficit um when all the onetime monies are exhausted and then lastly for year 2324 um the district is projecting to end the year with 7.8 um 3% um of the reserve requirement um equates to about $3.9 million which leaves about $3.9 million above the reserve requirement and again the UN the the the balance will be used

245to mitigate structural deficit when onetime funds are exhausted and this last slide for you right here I pulled off um straight from school Services um they've done a study in terms of the um the average unrestricted general fund ending balance Statewide um as you can see here um for unified school districts it's about 18.82 um Elementary School which is us um 22.7 and then High School 17. 34 um just a point of context is also for comparison purposes um at the height of our at a reserve level which uh right now we're projecting in year 2223 um the district Reserve percentage is approximately 177% um so when compared to this um this study um we're still below um kind of Statewide average um to about 5% and with that I'd be happy to take any

246questions thank you um I'm gonna go ahead and put you on mute until uh we answer for some reason the feedback sometimes okay um any questions or comments a trusty fam yes a question to assist superintendent Chang uh you know we heard in public comment you know uh regarding the question of 50 you know uh funds in excess of $50 million coming to the district uh you know uh uh you know um I I think I may have a grasp it but if you could clarify you know if you could explain to to to the board and the general public about you know you know what is uh you know where where you know what is this money where is it coming from and uh you know what could it be used for can I

247can I answer Madam president yes please uh thank you and thank you for that question uh trusty fam um and the comment I made uh that was made about um the one-time funds that equates to about 15 uh $56 million um that is true um the district is uh and will be getting um onetime funds um equating to that in different parts of money um and I can give you a breakdown um right now um you know um if you if I can put up my screen again screen again okay so we'll start with this slide in terms of a summary of all the revenues that we've incorporated into um next year's budget and also um the budgets in the oute um starting with the in-person grant um that that was the grant related to

248a um um ab86 which is to uh provide inperson instructions um that amount is $3.1 million uh the expanded learning Grant um this is for really for supplemental um Services um to either increase uh the school year or extend the school day or extend the school year and also to provide um additional support uh related to learning loss um the next part of money is the um one-time Federal money the Sesser 2 uh which is $10 million and then s three is approximately 24 uh. 45 s money in general um there's a broad usage um parameters around there except for S 3 there's a requirement to set aside 20% of those funds for learning loss so if you simply just add up these four pots of money um they come up to about $42 million

249um you may recall that uh in a previous board meeting I presented um all the co funds that were being used um that amount was approximately $14 million so if you add the two up um you know it comes up to um uh $56 million that has been stated um so those are the pots of money that we're getting one time um some of it have been used already this year and then the remainder of it the $42 million will be you um in in the upcoming years okay and then I have a followup question so for the eser3 refunds for fiscal 2223 uh now I understand there's a 20% set aside for learning loss but there is the 80% or the [Music] 17.96% and let me pull up some language um yes so um

250in general um you know the the school Services put it out a nice tool that uh lists all the allowable expenditures and one of the one of the um one of the comments or the language is there it says other activities that are necessary to maintain the operation and continuity of services in Lea and to continue the employment of the existing staff okay I see okay so I so uh I that's that is quite broad enough for me I uh thank you very much assistant superintendent Chang for uh for accounting for those uh that those uh the onetime monies as well as uh informing us about you know how broad uh a portion of the federal funds could be used for and if I may um add to that um this slides right here in

251terms of the unrestricted general fund um as I mentioned um you know the one-time fund has been keeping the District of flat and so if you see um in year 22 23 um in the unrestricted Federal fund there's an other adjustment um of 17.9 this is the the portion of S3 money um that we'll be using broadly to pay for current uh services to maintain the operation of the district and so um you know without the $17 million that we be using um to pay for some of unrestricted general fund um expenditures um you may have recall that um you know when we take that money out instead of us incurring or generating an an operating surplus of 4.5 we would actually be drawing down or spend or deficit spending about $ 13.4 million I

252call correct yeah so 13.4 million do um so those are one time PLS that are keeping this aoat and if you look at year 23 24 here without all the one without any onetime money um you know the district is starting the year with 20 3.3 um but however uh we're burning down $15.4 million in reserve um to end the year with only $7.8 million so um you know the onetime money as I mentioned before um essentially have mased um the ongoing the current and ongoing structural deficit that the district's experienced and once those onetime U money goes away or have been exhausted um you'll see the true reality of the district's budget when when the one time money no longer exists righty uh thank you very much assistant superintendent Chang thank you um I

253see trusty Chavez hand up uh yes I have a quick question so um when you when you calculated this could you tell us the number you calculated on the average uh on the declining enrollment please which an exact number which portion of the of the revenue talking when you when you were saying about um the when you were calculating the the average that in the declining enrollment what average is that uh 300 400 what what number did you use um so for next year we're showing a decline of close to 300 but in the second and third year out it over 400 for each year so each year you calculated a different number is that correct factoring declining enrollment in the out years to 300 for next year 400 for the following year and then

254what about3 an additional 400 okay thank you thank you yes thank you see your hand up yes thank you uh thank you Mr Chang um so over the past you know amount of months or whatever um you know we've been kind of running off some assumptions about what our what our deficit looks like it may be going forward and there's been you know all these different in injections of one-time monies and different adjustments that you've had to make along the way um and obviously as you mentioned we're going to recalibrate our demographic study so that may bring some differences but I guess kind of in a nutshell does what you're presenting tonight vary in any significant way from the assumptions that we've been running on which is still that we are in a a whole

255roughly s million is is the number that I think we've been using as as kind of the deficit that we need to Target to try to make up somehow is is does this report reflect anything significantly different than what we've been assuming in the past several months um I mean things things to continue to change frequently um you know I mean if you just look at what the state proposed in January compared to uh what came out in May um there was some significant changes in terms of um for one thing the cola the cola went up by close to um a little over 2% if I calculate that correctly L um so that was the one significant change um but other than that um you know the the S3 um was not included in

256um this year's budget first interim or second interim second interim because um that information was not available until May Revis when it was solidified by the state um as a part of the May revision proposal and so with that information we were able to incorporate that into um not next not only next year's budget but the year after that um to to include that money um and so you know um the budget that we've been presenting um was for this year and two out years and the budget that you're seeing now is for next year and then two additional out years and so the the the third year is is kind of um where the big change occur right because um and and when you're talking about deficit spending um you know that $7 million

257that we had uh reflected back in oh gosh budget adoption or first interim um that number you know changed um somewhat because of the changes assumption um at the state level um but again um you know as I shown in the third year out um if you don't do anything and all the one time money goes away we're projecting to to spend down our deficit by $15.4 million um and so you know things are continue to change constantly and you'll see that um you know from now until the state enacts their budget um there's going to be some other changes as well um because the the legislator still um I know the legisl the Senate and assembly has agreed but the governor still has a say in what goes into the enacted budget um and

258so you know we're still anticipating what that outcomes going to be okay so then as we as a board um continue to think about things like our staffing levels um you know uh consolidation or closure of schools we're in a b we're still kind of in the same ballpark than it sounds like of having um be in that same frame of mind in terms of having to make some of those tough decisions um it's not like we're hearing anything tonight night that significantly changes the the path that we've been kind of going down obviously with the exception of not knowing what changes may still be coming but just in terms of our mindset as board members and how we're thinking about moving forward with some of these other budget impacted decisions it sounds to me

259like we're still kind of on track with where we've been going yes although specifics may change but in as from a a zoom sorry and I yeah I agree with your statement you know the biggest Factor impacting the district's budget obviously is declining enrollment um you know the loss and revenue um that we um experience with just losing um students far out outpace and outweighs um any cuts that we be would be able to make in Staffing um and on top of that um you know operating cost doesn't go go down um utilities keeps going up um you know the cost of um pg& and all those other operating costs um continues to go up um and so you know the again the the the biggest Factor that's that's impacting our budget is losing students

260and what that means in um losing um uh funding for that that are attached to them okay thank you okay thank you thank you any other questions or comments Mr Chang um okay I'm going to open it up for public comments at this time um Jose if you can help me out yes board president at this time we have uh no speakers okay I'll give them a few seconds in case they we're hitting the raiseed hand button do we have any at yes we have one speaker Chris Clark you have two minutes please unmute yourself when you in speaking the timer will begin hi my name is Chris Clark and I represent the alamro Educators Association and I just have a question about the I think um assistant superintendent Chang you said $56 million of

261onetime money and then I heard um Ernesto mention that there was like a $7 million deficit so I'm wondering um I think on one of the pages There Was You Know $56 million divided by 7 Millions would would last several years I mean more than just two or three so what was it that the extra money was being used for I mean the declining enrollment over a few years is in 56 million sorry was she done I know her two minutes wen't up yes I'm done question is okay thank you6 million being used for because the the the declining enrollment isn't um taking up um all of that money and so I'm I'm sure what the rest of the money is being used for okay thank you so much um Jose was that it um

262yes board president thank you um I'm sorry um excuse me we have one more speaker okay Miss josn Ms okay before we go to her just want to remind our public that um we're not available to um answer questions back and forth um thank you welcome back miss m thank you uh I understand that you can't answer questions but I do hope that you're prepared to ask some when I look at some of these numbers first of all if $56 million isn't going to satisfy issues of alumrock I think we we have bigger issues than we're even considering um but I also want you to take a look at with declining enrollment there should also it should also reflect declining expenditures what I saw was an increase in classified salaries of $4 million next year

263and the year after I also saw an increase in benefits employee benefits of over $4 million in the budget um I don't understand how that's even possible let alone likely when we are expected to lose what was it 15 teachers next year or the year after and I mean we got to be realistic this is not adding up but what does seem to add just absolutely Balan to the penny are the expenditures and the revenues the third year out it's just amazing that that can even happen thank you was that it Mr Travis Madame President yes at this time we have no more speakers okay thank you um Mr Chang I just I know you presented on this already and just want to um reiterate and make sure that I'm understanding correctly in regards to

264the um for example in regards to the insurance um my understanding is uh and I think it's on um slide six where you talk about the insurance um increasing from 05% to point to 1.23% is that correct yes that is correct okay so I just want to you know uh highlight and make sure that we're all understanding and looking at the right numbers um and then in regards to the $56 million um if we were just looking at this one year you know we'd probably be out and you know but we're looking at the the three years projected out and so although this year and next year we as a district um you know that would support um looking at the bigger picture in regards to our finance es in our budget as a district

265uh by the end of 24 um we back to um after the one-time funds are used um you know in the different areas um that money is pretty much used for what it was given for right and at the end of the third year out we wouldn't be in the same position that we would be at the end of this year and next year he if I understand let me try to um answer your question if I understand it correctly I guess I'm just you know in regards to some of the questions I just want to make sure that we're all understanding that although this uh 56 million the money that the number that they keep pointing out um that we're looking at the proposed budget for not just one year if it was just

266one year then you know we'd have extra right but we're looking at three years so at the end of the three years have extra I guess is what I'm saying based on that on the on that U money no can I answer yes please okay yeah I don't know if you were not understanding what I'm trying to ask your make sure that we all understand these onetime funds yeah so I I think I understand your question and your statement um yes the F the $56 million that we're receiving in one time um it's not going to be used up in one year um you may recall that $14 million of it is going to be used be used in the current year um in addition to that um you know you have the $10 million

267Esra that we're planning on using for year 2122 um and 27 um sorry um $22 million in S3 money in year 2223 so um and the other piece of the grant was the inperson and also the um the expanded learning Grant which have very restricted uses of those money and so all that all that onetime money um has been Incorporated um into a budget over a threeyear period and with that onetime money uh were're able to keep the District of flat by paying for current expenditures with those onetime funds uh for some reason it's in my head but you're able to say in a language like Joselyn said right it's like another foreign language to me you're able to explain it um so thank you for for restating that um okay does anybody else have

268any questions or comments for Mr Chang or the staff before we move on okay thank you so much Mr Chang um at this time where I do see a hand uh trusty withano yeah I just want to I thought maybe I it seemed like Mr changen had another comment to make there at the end I just want to make sure that we're not missing something that he was gonna say that might be helpful Mr Ching no I was done oh okay oh man I see trusty Chavez's hand up do you have another comment or question I think I was going to say the same thing because I thought he got cut off but uh thank you very much for the presentation Mr CH thank you thank you and I apologize Mr Chang if I cut

269you off thank you again um okay so we'll go ahead and move on to item 505 but before we do that um I just want to extend um or get a motion to extend our meeting because it will be here pass if I can get a motion um motion to extend extend the meeting till 11:30 we don't have to go that far can we do midnight pardon can we extend it to midnight sure uh a motion to extend to midnight okay trano you're on mute oh you had your hand up yeah um I got sidetracked with that little motion um you second I'm pass on it I forgot what I was going to ask okay do you want a second though you were GNA say second oh I'll second thank you all right um we

270don't need to open it or we do public comment no thank you okay all right so um we just vote on it or we're good vote on it okay trusty Chavez hi trusty kto hi trusty fam trusty fam midnight oh he's on mute he said I hi hi hi trust youo hi and myselfi okay I did question um for Mr ch um so a little earlier truste fam had asked about the a little bit more specificity on the broadness trusty do you mind if we um open it up uh open up the public hearing and then ask a question regarding the that's fine that okay I just want to open that up on a uh 505 the proposed 2122 budget adoption I want to open it up now and we'll go ahead and open it

271up for questions and comments go ahead thank you okay um so trusty fam had asked earlier about the broadness part of the how the expenditure how the money could be used and you mentioned that some of it could be towards um the continuing to um I forget the word I'm not employee But continuing to pay for uh can do you you know what I'm talking about can you refresh my memory on the uh the broadness of you know what the federal government allows for expenditures to be used for under the definition of broad usage and there was a piece that you said you read at the end that was kind of specific to um you know the ability to pay for continuing to educate students or something along those lines yes I can I can

272reread that statement um and it it reads other activities that are necessary to maintain the operation and continuity of services and leas and to continuing um the employment of the existing staff okay and did I hear that there's some portion of that's already budgeted in like 17 million or 19 or something like that that we are in fact dedicating towards that direction that's in year 2223 yeah okay okay that's it thank you thank you any other questions or comments um from the board on this item okay I'm going to go ahead and open it up for public comment at this time PO said do we have anybody from the com U Community wishing to address the board on this item none for the from the community at this time okay I'll give them coule seconds

273just in case they we're heading to the unmute or raiseed hand button any now still no hands okay thank you so much with that we'll go ahead and uh move over to 506 um and I'll close the public hearing for 2122 budget adoption right [Music] um moving on to item 102 uh Dr Bower is that um something that you we're going to address or do we have a presentation we have a presentation and I'm gonna turn it over to Mr Sanchez thank you welcome Mr Sanchez thank you thank you uh board president uh members of the board superintendent Bower uh today we wanted to share with you uh some concrete data of the work that our students um have been doing um with a tremendous support from our teachers and other partners um we wanted

274to capture and summarize for you all the assessment that has happened um and how we monitoring student progress and then also share with you some of the highlights in terms of the growth and how we're supporting students um as as we grapple through the learning loss and some of the learning gaps um as and we as we address address them through summer programming and um as we look at next year so with that I will ask Miss Britney rles to um share the presentation and then if if you have questions um if we could save Until the End um that would be great hello can okay can you hear me now yes okay this new uh webinar format's throwing me off uh welcome hello my name is Britney rles I'm in academic services and thank

275you for giving me the time and space to go over some important um academic data with all of you I'm going to share my screen um so today I'm going to show you um a little bit about the assessment Adventure we've been on over the last year as it relates to our academic testing um and we did this a lot of this remotely during the last year um last fall in 2020 I will remind you that we had our initial lpac window extended from 30 to 75 days um in order to give districts more time and space to um meet the needs to uh assess our students to make sure that they to determine whether or not they are English Learners um also in the fall our second through e8th graders took the first diagnos

276diagnostic assessment um in ela and math that's our local assessment they took a second one in the winter of 2021 in January and then in February we began our long Summit of elpac Journey um in the spring our students took the third round of the Diagnostic in El and math and then we continued the lpac journey um so I'm going to start with some elpac I don't have data yet from the summit of elac that will come this summer um but until then I can tell you a little bit about our initials and just the process that we went through so we tested 542 students on the initial Pac um we continued testing those students who were newly enrolled or uh TK students when they turned five so the initial elpac runs throughout the whole

277year uh then we had to test 3,414 students on the summit of Alpac for both of these assessments we administered all four components using hybrid Administration this means there was some remote and some in person um this is what remote testing looked like in for the summit of elpac you'll notice our adorable students um just showing up in all kinds of places and spaces to do their four components of the test uh this took a matter of 21 academic Services testers that accounts for all of those contracts I kept putting through um because we needed academic Services testers uh it accounted for over 4,000 hours of testing and there were 13,678 parts of it completed uh that was that number is actually a little bit higher after we ran the numbers um when we were

278totally complete last Friday uh so as you can see it was a huge undertaking um and I have to do a big shout out to all of our academic Services testers um as well as our teachers and our uh site administrators for supporting all of the work because it was not an easy task um and I'm very proud to say that we definitely um we from starting from February 1st up until last Friday we we gave it our all and we tested a lot of students and it was an amazing experience and one of the highlights of my year definitely to to see our students in action then in terms of academic testing um as you may know in April of 2021 the Department of Education as well as the California Department of Education released

279the spring Administration flexibility guidelines so this was a set of guidelines that we had to follow um it meant and and this was the guidelines if you could meet those guidelines then you could determine that you're going to be using local assessments rather than the Casp which includes the esack cast CA and CSA which means the smarter balance the California Science the California alternate and the California Spanish test we determined that those were not viable options for students to uh to administer those to our students so instead we went forward with doing a local um assessment um that our local assessment being fastbridge um so this this graph kind of this chart here shows you what the assessment was who takes the assessment and our plan for the spring of 2021 because we felt as

280if the smarter balanced assessment was just not a viable option for us we determined that it was not a viable option because of connectivity challenges um the secure browser Pro just makes a lot of challenges you have to have the secure browser on a device um so if you're using a personal device it makes a little bit more challenging you have to have a really strong connection um internet connection and that's not always viable option and then with changes in distance learning and the in-person instructional schedules it was just very hard to pinpoint where our students were going to be at what times and so we felt as if administering Casp this year was just not the right choice for for alumrock um the flexibility guidelines outlines that you have to make sure that the

281test is aligned to the Common Core State Standards um they're available to assess all students in grades 3 through 8 are formally administered across the grade bands and um that the results can be provided to parents Educators um and School staff in order like about individual students so that brought us to um fastbridge as the assessment that we wanted to give so a little bit about our local assessments so in conjunction with these State assessments we have um local assessment in order to monitor progress of our students um in TK through first grade we do a series of foundational skills and we use a platform called esgi for 2nd through 8th grade our students use fastbridge um for both reading and math we also monitor the progress of our students reading levels through Benchmark level

282screeners it's a oneon-one assessment uh running record and then in addition to this we also monitor our students withal data so we're looking at Panorama data um this from Panorama surveys and those are done in the fall and spring for our third through eighth graders so this is just to kind of give you an overview of what our students take throughout the year so I'm going to go through a series of data questions so I'm going to pose the question and then I'm going to try to answer it using some data our first one is how did our students do on the last espec assessment so going back to 2019 our students uh took an in-person assessment this was the last time they took the S back and you'll see this chart shows in purple

283is Ela blue is math and it shows the last five years of data and um the percentage is students meeting or exceeding standard this next slide um again shows the same same set of data but we're looking at it by grade level again Ela is purple blue is math um and the N down here that shows you the number of students who took the test um our next question is how did our students do on local assessments prior to school closures so for this we're going to be looking at the January 2020 I ready diagnostic um in this chart it this graph it shows us our students in grades 1 through 8th again the N shows the number of students this was the last time our students took um a local assessment in person prior

284to school closures due to the pandemic and I just want to make it clear that the I already diagnostic um these numbers when you're thinking about standards met and exceeded you're basing it on the fact that students are going to be having an additional four months of instruction towards the end of the year grade level standards so this is you know not to say that they weren't on track this is to say that they are on track they have more instruction before they take esack I just want to make sure that's clear um based on teacher feedback um and from surveys and whatnot we teachers were requesting more actionable local data for instructional purposes So based on that we determined to move away from I and adopt the fastbridge assessment system and and um we

285have two big goals around it so our first year um which was this year we wanted to implement the three screenings um for ELA and math for our second through eth graders next year we're going to and we did a lot of PD around Administration and some around looking at the data um but next year we're really going to make an emphasis on how we can create more um a learning series to really um um make sure that our teachers know how to effectively effectively utilize the data from these fast brige assessments um they can create intervention plans and so that will help them determine their tier 2 academic supports um so we have a a longevity idea around fastbridge and this was kind of our first year to dip our toes into the water

286um and our teachers and students did really well in implementation across the board um this slide shows that in March when that it went to the board um the State Board of Ed uh when they did they were trying to determine whether or not we would be doing esack across California this graph was um shown out at the meeting to show different local assessments um as you know leas can determine which set of local assessments they want to give their students um and this is just a graph to show you that some of the others assessments that were being used I ready Star by Renaissance this other category is a lot of like locally um Chosen and determined um determined assessments maybe they created them you'll see all kinds of other like reading inventory by

287hmh there's and there's fast Bridge there there's lots of different kind of tests so we were all given the opportunity to use those as our um academic measure then the next question is how did our students do academic Ally over the last year of distance learning um this first graph shows you the math um the fastbridge Diagnostics you'll see that in yellow and green is our standards met and exceeded um and you'll see that we had a fall screening a winter screening and a spring screening so in the midst of all of it our students still got on and took an assessment so that we could see how they were doing and monitor that this is math and here is reading um this is looking at math cross our grade levels again the yellow and

288green is your standards met and exceeded and here's reading um then I wanted to look at the data based on school here's Middle School mathematics and we're just looking at standard exceeded standard met and exceeded at our different middle schools and here we have Middle School reading onor above here we have the same graphs but only in elementary we're looking at our second through fifth graders here in math and in Reading um then on the um score reports you're going to these are going to be sent home via parent Square parent Square you're there's a a feature in there called secure docs share and it goes through and the uh parents are going to be able to see score reports um so we're going to now be moving away from sending them home to putting

289them on parent square but if you don't have parent Square we you can still go to your front office and request a printed report and front office staff will be more than happy to accommodate that request so these are just some um Family reports that you receiving soon that go over how your student did um we are going to be changing ours up a little bit to add all three Windows of assessment so you can see the progress of your students we're going to be sending out more information on that shortly um the next question is how how does the academic data compare so when we look at um the three we chose these three um academic measures to compare our students but it is very nuanced so I want to I want to spend

290some time on this first we have here the spring 2019 esack and the reason we chose that is because it was our last administration of cast in person um and it is what is you know shared on the dashbo board then this January 2021 again is the data that um it has the that was the last time we had a local measure in person prior to school closures um but I do want to also I want to reiterate that the caveat here is that students have an additional four months of grade level standards instruction prior to espc testing and then the last one here is our spring board or or our sorry spring 2021 fast Bridge assessment and that was administered remotely in the spring of 2021 and I'm gonna hand off this next slide

291to Barbara I don't know if Miss Campbell is in um but she's going to present this slide about some of the things that we have coming for the summer and then other learning opportunities in the fall I don't know if she's on oh there she is good evening can can everybody hear me yes good evening welcome good evening thank you so I just kind of wanted to um wrap this up by talking about um what we do once we have all this student data um you know we really look at trying to figure out how can we support the whole child as we move forward into the summer and fall so some of the pieces some of these pieces you will be familiar with that we have shared but moving into the summer if you

292look at the slide there's some items in purple these are some of the the the tried and true academic support pieces that we have put in place previous years that are very successful that we are using again this summer um as you can see we have bridge to kinder but a new piece that we're adding this year is bridge to first grade because those students entering first grade had a full year of not being on campus in a kindergarten classroom so having that opportunity for them was very important for this summer we are bringing in read code draw which is a combination of a program that is a literacy tied into to coding and drawing um online program for students our summer ELD program this summer we've brought in a new National Geographic program that

293is going to re that's I think really going to motivate the students to part to uh engage in speaking listening reading and writing we have audacity this summer we have a couple of um programs at two of our middle schools and then the Eld programs are going to also have audacity as a component so they'll either have a dance class or a visual arts class or a theater class drama or storytelling built into their ELD class during the summer and also sports for Learning and think together so again these are some of the things that we have in place this summer a lot a lot of these programs we have we use the data that was there to to designate what students qualify for these programs um every every program that we work for and

294everyone that we're putting in place we had designated students that were either based on their data our data and teacher and principal recommendations moving forward in the fall some of the loaring learning opportunities that we're putting in place again these are just some of the pieces is the continuing the newcomer ELD in interventions that we did this year around for students that are English Spanish and then students that are English Vietnamese and that's just an additional support after school that we had great success with this year that we want to continue imagine learning language and literacy is a program that's that focuses on foundational skills for TK through grade two phonetic uh phonemic awareness sound recognition s um uh site words things like that that we really and it's something that the students can work

295on at home but also work on as a center in class so that's going to support some of those foundational skills that some of our students may not have gotten throughout uh this school year we are providing uh site funds uh for interventions and also homework centers at each site so that students that need that additional support with their home homework with assignments with projects will have a place that they could stay and go to and get that help also we're going to we will continuing some centralized tutoring for prioritized students that um around in one-on-one tutoring or small group T tutoring and also we are going to continue to bring back some of our ad some of the academic platforms that we have brought in this year that provide support to the teachers and

296assigning specific things to practice the standards that they've taught but also just additional learning platforms for students to practice at home or again in class so again just a little idea of how do we take the data and apply to what we're planning moving forward as we move into the year and with that that is kind of snapshot of how our students did I think we're very pleased to see that the students really have um shown resilience this year as they move as they've had to go through this with us with our with their teachers and their families thank you so much um thank you Mr Sanchez and Miss reel and uh Miss Campbell for this um very detailed presentation and also additions I had some questions during my one-on ones and it was nice

297to see um just the additional information um you know just to highlight on our children right to see where we where they are at um considering this you know pandemic and social distance learning and all the U you know even taking the test from home and you know the bedroom and maybe sharing spaces with with siblings um the fact that they did so well considering you know all that um so that was you know great to see and of course you know as um as a parent and one of the leaders you know we won't stop until we see 100% of our students doing you know well right above grade level and so it's good to see um all the programs and support that we have in place to support that um you know to

298work towards having all of our students above grade level um on or above but of course we all prefer above um so at this time I know it's on for information only but I'll go ahead and open it up to the um trustees I see trusty fam and trusty Beano I'll go ahead and start trusty fam uh you're on mute getting used to this uh first of all I I want to thank academic services and all the teachers and staff you know for working on our students and uh keeping them uh in two very difficult academic years one where it ended on you know on a chaotic note as we were scrambling you know just as the pandemic H you know happened in this full year of distance learning so I'm you know we've still

299got a lot of work to do but we've the fact that you know between between 2019 and 2021 our students have held their own uh you know as a testament to the uh commitment of our classroom teachers uh the only question I have is you know I uh you know I remember standardized testing as you know the the book you know the book and the answer sheet where you bubble bubble the answer so um uh you know you know for for the board to know and uh the the community uh what is you know what is fastbridge testing like I you know I I know that if they're taking it online virtually but you know just to give a nutshell description of the testing experience yeah uh that's a great question fastbridge is a computer

300adaptive test so um it's about a 30 minute test for each one and when they when they get the answer right it gives them a harder question and when they get the answer wrong gives them an easier question that's how it can be fast and it can give lots of data around how the student is doing um in that one obviously just that one point in time okay yeah okay thank you very much so no more no more scantrons where you got to bubble in the answers okay thank you so much thank you trusty trusty so along with that I'm assuming no more number two pencils either I guess have that ready uh but first of all I just wanted to obviously thank you for the report I always appreciate those visuals and the graphs

301and I think that makes a lot of it easy to see um and I want to just comment that um you know over this this past year plus I've kind of in the back of my mind been just kind of cringing thinking as we were hearing about and reading about and learning about you know learning loss and all these challenges and I was thinking when the numbers came out you know I was expecting significant decreases in in you know in our scores and and I was kind of expecting that and preparing myself and when I read this report I know there's as you mentioned there's a lot of nuance you know there's not we're not necessarily comparing Apples to Apples and all of these but from a broad sense that I mean the numbers are

302what they are and so I'm super excited and happy to see that our students have have you know performed very closely to what they performed in person and I think that speaks to a lot of different things but I think it speaks to the work in spite of all the challenges throughout the past year and you know differences that we may have had um from parents to teachers to District staff to board members overall we have put together a package that you know whether it was providing food to our children providing devices to our children having tech support um providing the Frameworks and structures at the district level to allow some of this work to happen all that stuff to me is all part of it and and most of all as trust as president

303ER men is our children um you know and that one of the things that I always talk about when it comes to alen rock as as a graduate as a parent from Alam Rock and just a lifelong person here in the east side is that our students I think this has been a challenging time for all students all over but I think it's not the same for many students across let's just say our County as it is here in Allen Rock and I think the resilience that has been mentioned is significant in the broader scope of educating our children because we can educate them on ABCs and one two 3s but those intangibles about how to work through challenges how to be resourceful how to be persistent the things that our students needed to do

304to to be reflected in these scores and in our staff too that resilience I think is what separates us and I think that for me I can speak personally those skills of learning how to be resilient have paid dividends later in life you learn how to deal with adversity and so I just want to thank all of our um all of our team from students to parents to teachers to staff to everybody I think this is a reflection of the hard work of everybody um and like I said I was very surprised and very happy to see that and and you know again as always there's improvements that can be made and and we can always do better but I'm Pleasant very pleasantly surprised with what this report is showing us tonight so thank you

305for that thank you trusty wano and I agree 100% absolutely and all those things thank you for U making those points any other trustees that would like to say anything at this time um it was that Linda yes go ahead trusty Chavez um actually I'm I'm disappointed um I understand that the kids aren't in in improving as well as they should be and the distance learning should not be a reason to expect drop in scores um we need to get better um and I don't know I'm just disappointed there's still a big number who are not achieving as well as they could and we can have a talk about that later thank you uh trusty uh you know thank you madam president I I you know as a member of this board I I highly

306resent what trusty Chavez just said I mean you know look this has not been an ideal time I mean we're in a position where we've had to deliver meals to needy children we've had we've had deaths in the family we've and uh people who have lost jobs uh you know the fact that the fact that we that our students have held their own with the help of uh our teachers and classified staff I believe you know granted yes there is always room for improvement but you know I I remember to a time when I was in high school I was taking a test you know and just right before the test someone threw threw a white out bottle and instead of you know the other person supposing as supposed to catch the bottle I got

307hit in the head with the uh with the white out bottle and you know though I was in no condition to take the test five minutes later so I you know went to the nurses office and that to take the makeup tests and uh in many ways the you know um a lot of things goes into the Ed you know goes into uh you know a kid doesn't you know can't just pop a child in front of a computer and ask them to learn uh you know that's why we provide uh breakfast lunch we provide you know technology so far we provide uh social and emotional learning you know the part you know part of part of getting it State of Mind of learning is to ensure that a child's primary needs are met you

308know I think it's awfully horrible that you know instead of you know celebrating this this success you know in in pandemic times we would you know uh discourage our our children and demoralized that you know the teachers and the staff who who work for us thank you very much thank you trusty fam uh trusty with yeah um I mean I I Echo pretty much what trusty fam has just stated and I want to thank you for that and I I just to this point I just wanted to say that it's it's one thing to have high expectations and and I don't I'm gonna go ahead and assume that maybe that's what trusty Chavez is is kind of working towards or alluding to and I agree with that we all have and should have high higher

309expectations than what we achieve every year our goal should be always to be better but it's also important to understand the experience of and the uniqueness of our district and our families and and how that plays out and you know measure that our expectations versus the reality of the Allen Rock experience and so I wanted to say that but I also um on a different point wanted to speak to Miss Campbell's part of their presentation all the services that we are providing all those um Supportive Services and and you know it's been stated tonight and to my knowledge those are a lot of those things are not things that are offered to the extent that they're offered in our district and I also have um you know I have I'm of the understanding that when

310they are there there's charges for them and for our district I know that month after month as a board we're approving these contracts 100,000 here 200,000 there you know 350 there so so when questions come in from the public about where is the money going and things like that those are valid questions and and the public deserve to know but I think it's important when we see these types of presentations and all the services that are offered by our district that separates us from many districts that those Services don't come free and and a significant amount of our budget goes towards social emotional learning and all these summer programs and all of these things so you know when we're looking at how much money we have to spend on things we have to keep in

311mind what we are providing as a district that in many ways separates us and and you know and it differentiates the quality of our services to other areas so that's all thank you thank you um trusty Chavis yes um I know that there was a lot of parents that were not happy with the results and I know that you know we can do better and that's all I'm saying yeah do I have high expectations for the kids yes because these kids are are smart and they can learn um that's it thank you thank you board vice president kto I think I think we've been down this road before uh these type of comments are it's free free country you can have your perspective but it's unfortunate that um they don't they don't reflect the reality

312they even even outside of Co our children are facing some very difficult challenges and I'm not speaking hypothetically or abstractly I'm talking about my personal experience having lived in Alam Rock and having moved from school to school to school to school constantly and facing those things you know I like to claim right now forced me to network and to have to meet many people but that really messes with you every time having to connect with new friends with new teachers with new people and that's a thing that our kids are facing that many kids in other parts of the valley aren't facing and to simply just disregard and throw away the successes that we do have is just very very responsible and you know it's something I don't appreciate uh both as a child who

313grew up in Elm Rock and now an adult and uh and and on behalf of all those kids who are going through uh the challenges that are facing with the the fact that we got beat up the worst in the entire Bay Area uh with covid you know to not factor in that not factor that in into one's comments is very irresponsible um so I do go ahead and I I give props to the teachers and to the kids who in the face of adversity went ahead and demonstrated that they they could step up and go beyond where they are where they were in previous years so those are my comments thank you vice president GTO and again I agree 100% And I think it's pretty clear where we're all at you know and we

314all have the right to think differently um you know and um being a mother you know when I hear these kids you know it is our kids it is my daughter I did see her struggle during this pandemic and it was not easy as a mother and seeing my daughter's struggle knowing that you know um and she was going to be taking that test um when I hear these kids I you know it just does something so I just want to remind us these are our children you know you know and um some of us lay our children to sleep um and cuddle them into bed and so there are children I'm so proud of how much they're doing I'm so proud of our District staff I'm so proud of um you know the programs

315the those staff that decide to work in the summer you know and not take a break because we believe in our children um and we know that they're capable of um doing so much more um so I think we can agree in that right that um our children can all do so much more we all grow and learn every day and so um thank you all for being a part of that I'm going to open it up to public comment at this time um Jose do we have anybody on wishing to address a board on this item uh yes board President we have three speakers our first speaker is Brenda Miss Brenda you have two minutes please unmute yourself when you begin speaking the timer will begin hi um thank you um I just wanted

316to um just say that you know seeing the scores that you know with everything that we've been through um but I'm looking at this course before covid it was less than uh 50% that our students are reaching their levels um and before covid I mean that's unacceptable um I know that we can do better I know that our students are resilient but that should not be an excuse to um not have the services that are um they should be given um I do want to thank all these new supports that will be coming in for the summer um that hopefully will help our students because we've been through a lot I'm going to say um as a mother of a child um who struggled during this year I'm not going to look at scores this

317year because I don't believe that um they're even valid um for whatever every student went through and um the lack of training our student our teachers got this year with um was horrible I'm going to I'm going to say it uh because I know that a lot of um teachers still don't understand how to breakout rooms and it's really sad that our teachers struggled with a lot of new programs coming in um through to co um would love to see our district support our teachers better and our ELD students we have to do better with our ELD students but overall our special ed I don't see much support in the summer for our special ed students I would love to see um ABA more therapy um more speech more counseling for our special ed students

318because this is a big large group in our districts that I don't hear a lot of conversation about but this these students in the ELD students the ELA students and all of those students need that support so um I would like to see more math intervention as well more strong math intervention programs to help our students that need those fundamentals of ma to be able to succeed thank you next speaker is Miss D and B member SSA you have two minutes please unmute yourself when you begin speaking the timer will begin hello um once again um parent of two students that took that testing this year I have to say that the scores that they got this year is the less worry that I am about I'm more worried about their insanity and more help

319I'm more worri about their mental health and their anxiety um as a mom and as a an advocate I have learned that ex D testing are here to put our kids down they are not made for the majority of our kids they're made for um for other cultures and I had to be honest and open about that I tried to take out my kids out of taking that Tes and unfortunately I wasn't able because it is required it is a is a requirement for them and I honestly want to say thank you for the teachers that tried try their best let's keep in mind most of these kids don't have a special place to do their homework they had to share a room they had to share a living room with more than three siblings

320and having a quiet space to concentrate and to do a testing it's not available for them it's not their fault it's not because they're falling behind it's because we live in a rest in world where poor gets the hardest the hardest time and those are our kids I also want to acknowledge that yeah we are we've been behind and we've been alone in some of the other academics but if we measure our students by what they really know their art their culture um their language will be more successful lastly I would like to add that as we are in um bringing new programs and more things to our school district to help our students let's not forget about the programs that we already have and let's invest more time and let's give a little bit

321more weeks so that so our students can get back to their feet and come back um stronger and and better than always thank you have a really good evening thank you for your comments next speaker is Jessica leori Miss Lei you have two minutes please unmute yourself when you begin speaking the timer will begin uh can you hear me yes perfect um yeah as a RSP teacher at Linda Vista and someone who struggled with dyslexia her whole life um and someone who now works with with children with special needs testing means absolutely nothing um these kids took this test at the end of the year um I don't know one teacher who actually utilizes those test scores to Great advantage or you know development and these kids came in every day after that test exhausted

322angry sad parents you know calling and texting me being they can't get on um and I agree with you fam the um it's demoralizing um I didn't look at any of my students test scores um I instead celebrated what they were able to accomplish this year and what US as teachers and staff accomplished this year they learned so much not academics per se but they learned life skills they learned survival skills they learned grit they learned adversity they learned and they struggled with social emotional well-being as well as staffed so I think these are our children and we have to remember that and all the successes they did succeed in and that nobody remembers taking a test and enjoying it so I think we need to remember that that these are just one snippet of

323a whole child and how they can take a test or not take a test so please respect our students and our staff in how they were able to do this um in the face of adversity at the end of a school year um on a tiny computer Chrome screen in a closet or a bedroom or a loud kitchen um not in a quiet space so please um just remember that thank you thank you Miss Lei next speaker is Veronica Amador Miss Amador you have two minutes please unmute yourself when you begin speaking the timer will begin great thank you and um I also want to talk a little bit more about you know just with the testing as well and everybody had just said about um you know the way that it demoralizes our students

324and it just an overall awful thing um but on that note I also want to talk about the lack of support um for especially for the Kinder I believe it's um kinder the bridge to kinder program um that program um I know it's been around for 10 years and it's a great program I've heard so many great things about it um and so this year with my son he's eligible for it and unfortunately they had to cut it because they wanted to uh give the opportunity to all families and I definitely understand that there were many families that were interested um and why not it's a it's an imperson program it's a program that would support our students um but not only that this year they decided to add an extra grade and actually cut

325that so cut that quality high quality program into two weeks and the other weeks um parents do a session online um you know it really loses the high quality essence of it uh because it does take my child a little bit longer it does take other children especially in the early childhood development we know that many of our childr take a little bit longer to warm up to new adults to trust and be in an environment of that they feel safe um and so I do want to advocate for that I want to say that this should not be the year that you know if we are adding that we are still providing that support that it is a full and not cut and as well as for our special education uh programs that they

326continue throughout the summer and not just for students that qualify into the extended year but for all students um because to qualify into the extended year uh it takes a lot it takes a lot from par uh from the child to demonstrate that and right now it's much needed thank you thank you Miss am our last speaker is Miss Joslyn Miss Ms you have two minutes please unmute yourself when you begin speaking the timer will begin thank you I just I I just want to remind all of us that a test is really just a snapshot at One Moment In Time and I have two quick personal experiences that I would like to share um I many many many years ago go when I was getting prepared preparing to go into college and had to

327take my college entrance exams I remember being called into the I guess it was called the Dean's office at the time or the counselor's office I don't know after having taken my entrance exam and what being asked what happened I was a student that um not to brag but I did I my grade were in the top you know 25% of my class and I scored in the bottom 25% of the na on my tests because I have an extreme test phobia when I go in my brain freezes up whenever I hear the word test so it it really is not always a an accurate um assessment of how our student stud are doing I also remember being in as a fourth grade teacher in the classroom and and administering those tests and having one

328boy come in to begin his testing situation for the day after having witnessed his uncle being shot the night before and it was like who can how does that test really give an accurate assessment of what this boy knows it doesn't I mean again we just have we have to take it not not take those scores all that seriously there is so much more to our students and learning than a test thank you thank you for your comments Miss MERS we're president at this time we have no more speakers thank you so much um and thank you again for presenting uh at this time we'll go ahead and move on to item 601 um approval of resolution 49221 a support of Cal Care and medical care for all Dr Bower um who is on for

329this item I think vice president is that correct okay turn it over thank you h president um I uh bring forward this resolution and I ask my colleagues for support in moving forward forward with a sensible uh solution to a to an incredibly daunting impending CR it's already for us a crisis with um with regard to health care and the cost of healthare and just constantly increasing uh cost and so uh this resolution is intended to support uh calare ab400 and Medicare for all HR uh 1976 and it is quite extensive so I'm not going to read the all of the whereare asses but the extent of it is uh it starts off with whereas every person in the United States deserve high quality health care and then it goes on to lay out a

330significant number of uh points that I'm attempting to make about the importance of having health care and what is expended on average for healthcare already by employers and um the uh the impediment that that are placed upon our society uh because of the increasing cost of of healthcare and so um as I mentioned it's it's incredibly long has a lot of War ases I'm not going to read read each and every one if it was shorter I probably would have um but I'll I'll finish up with the now therefore be a resolve that alrock Union Elementary School District enthusiastically supports Medicare for all act of 2021 HR 1976 and calls on our federal legislature to work towards its immediate enactment and insuring health care for all residents the United States we have further resol that

331the alrock Union Elementary School District expresses it its enthusiastic support where California guaranteed health care for all act ab400 in cner St legislature to work towards immediate towards immediate enactment as uh um as I've mentioned um this this whole deal with uh Healthcare it's a it's a massive thing that's overtaking our entire country in terms of the rising cost um you would think that things such as Medicare for all Single Payer are the sort of things that only Bernie Sanders or communist support but in fact we have folks like uh the oraco Omaha Warren Buffett Mr you know free enterprise uh you know private sector guy uh advocate for uh Single Payer Healthcare seeing that you know we are in a position to go ahead and move forward uh with uh having the government provide

332Healthcare and that way we can go ahead and realize the savings that come from being able to negotiate those deals and make sure that um that the price of healthcare is um under control it's actually referred to uh the rising Health cost of healthcare as a tapeworm of American economic competitor and so that being said beyond Warren Buffett's desire to be more economically competitive I think the reason that we need Single Payer Health Care Medicare for all is due to the fact that it's the right thing to do we have a very complex society that now uh requires us to uh go ahead and deal with many many complex things and so Health Care is one of those things that now has become very inaccessible uh due to the rising cost um in the resolution

333I also make note that moving that away as one of the factors that uh employers have to deal with would relieve the budget and allow us to be able to do more with what we have such as providing um better remuneration to our employees more services and things of that sort with that being said I would go ahead and ask my colleagues for your support uh on this uh resolution thank you do you make a motion vice president yeah go ahead and make a motion second second by trusty Verano if it's okay with you all I'm gonna go to the um comments from the public and then um any comments or questions from the trustees after that um Jose can you help me out with that yes board President we have uh one speaker Miss

334Brenda Miss Brenda you have two minutes please unmute yourself when you begin to speak the timer will begin hi um I just want to say as a person who's championed and advocated for ab400 and a member of The Single Payer Health Care Coalition I'm here to support this um uh we've been doing a lot of work with this and um asking for support from so many entities and so many people that um can continue to push this I think it's important to have healthcare for all and I want to thank Ash Carla who is the author of this bill I don't think a lot of people understand what that means ab400 is um is showed the inequities with this pandemic how much it's needed especially um people the working class that always have to bargain

335for you know benefits do we fight for benefits or do we fight for higher pay so this gives families you know that rest of having to worry about you know having a particular job just to get the health care right or you know we have other people you know that um don't get that right and so they work only to pay their mortgage or their food so I want to make sure that everybody understands how important that is this is um something that it should be a human right I don't even think that we should be arguing this because um you know everybody deserves to go to the doctor without the fear of a Big Bill so um just wanted to be here to support this and um thank uh assembly member Ash Carla who

336has authored this and championed this along with a whole bunch of people that you know continue to do Caravans and I would like to see a lot of you guys join us um we have honk and wave Caravans where we do need support we do need elected officials to show up and you know having this resolution is great but we also need to do work in the ground level right thank you thank you Miss Brenda for president at this time we have no more speakers thank you I'll go ahead and open it up to the trustees for any questions or comments on this item trusty fam okay uh I uh you know I'll be supporting the resolution I mean uh for you know first of all uh no matter where a person is in is

337in life uh you know I I believe that a a a real prolife solution means that we ensure people uh you know uh one's socioeconomic status should not determine uh access to health care and and secondly uh you know uh yes the the cost of healthare directly impacts uh not just businesses but a district like us uh you know uh for those of us who who earn or earn a salary for a living and uh every year the the the was it the portion of the uh you know on the paychecks that where the what says employer contribution for healthcare it just keeps going up and at the same time the you know my contribution to uh my health care plan keeps going up uh you know and most recently uh you know I I've

338been uh was it I I enrolled in long-term care insurance and I just received a letter in the mail telling me that rates will be going up because of the cost you know increased cost of of medical expenses for the elderly in the future and I'm prepay prepaying for my elder care I mean my own old age care so you know for reasons of humanity and as well as uh reasons of sound economic practices uh that will enable us to do more with these resources I urge a yes vote on this resolution thank you um and if I don't see any other comments um we are we do have a lot of items on the agenda so I'm going to go ahead and call it for a vote at this time if you're all okay

339with that um I'll go ahead and call on uh trusty Chavez first no trusty Kinto hi trusty fam hi trusty Beano yes and myself yes um moving on to item 602 uh board policy 5141 point21 administering medication and monitoring health conditions first reading um information only so we'll just accept it as information only and uh we'll put it on on the next agenda thank you um comment yes every item has to have public comment yes thank you um so before any does do the trustees have any questions or comments before I open it up for public comment all right um Mr uh Chavez can you help us out is there anybody wishing to address the board on this item Madam president at this time we have no speakers okay thank you so much um being

340that we'll bring that back we'll move that forward um going on to 701 approve the contract with power school gr Group LLC for school year 2124 uh Dr Bower is this something you're bringing forward move approval second all right uh go ahead and open it up for a public comment at this time Mr Chavez yes at this time we have no speakers okay I'll give a couple seconds in case people are uh pressing the button to raise your hand do we have any now uh still no speakers okay we'll go ahead and open it up for uh trustees any questions comments concerns on this item okay see none uh move to vote trusty Chavez hi vice president kto yay trusty fam hi tryano I and myself I moving on to 702 approve the contract with

341YMCA approval second okay uh I'm going to open it up for public comment at this time Mr Chavez can you help us out yes we have one speaker Miss Miss Veronica Amador Miss Amador you have two minutes please unmute yourself when you begin speaking the timer will begin great thank you and um also this is another one of the great programs you know Contracting with ynca I did see the numbers though it was only going to impact 45 students out of 8,000 7,000 students um that could benefit from it and I understand we can't give it to all of them but we also don't have only 45 students that would be in need so um I really think about you know making more accessible and more um bringing more programs like this especially in the

342during the summer and for students um I know that the process that it was written there was by some kind of recommendation but um I would definitely love to learn more about how does the process work um how do we know that um you know like we are targeting um we not targeting but we are selecting students that are homeless students that are in special education students that are English Learners um students that are going through um you know that need that support because those 45 spots um just seem very I can't even think of a percentage um very small for the 8,000 students that we serve to be a full time um and so and I know that we're offering different programs throughout the month throughout the summer but this is a full-time um

343kind of thing and as we think about parents are going back to work as we think about uh parents that need to be back at work um because there won't have any more um kind of checks coming in from um from the from the state and as well as parents that didn't have that opportunity and that already back in work and that they have to pick other jobs right because most of our parents work not just one but two three or four jobs um so I really would love to learn more about the process and have uh advocate for more spots thank you thank you Mr at this time we have no more speakers okay thank you so much um all right I we'll go ahead and move on to um voting on this item

344if there's no questions comments uh trano yeah I just wanted to ask a clarifying question Dr Bower or anybody so um upon reading this item this this is the YMCA one correct yes okay so I I see that it's either I saw two different places 93 kids or 98 so somewhere in the vicinity of let's say 95 95 is that accurate close 95 95 youth for five weeks um I don't know the number of hours off the top of my head I don't remember this one but 95 children for five weeks works out to about $250 per student so um I'm comfortable with that for the for the value that we'll get for that but I just wanted to clarify that it was somewhere in the range of 95 students that actually are served by

345this thank you and just to remind everybody we have about 3,000 spots in summer programming thank you thank you thank you uh anything else trust that's all I just wanted to make sure okay and thank you Dr bar for pointing that out I know we had a very um extensive presentation on the summer programs so thank you for that um if I don't see any other hands up we'll go ahead and go for the vote on this item great uh trusty Chavez hi uh vice president kto Hi trusty fam iano I and myself I moving on to item 801 approv the contract extension for 2021 uh with um syy with maximum health care Staffing for speech therapist Services move to approve approve second I heard move to approve by trusty Bano and second by trusty

346Chavez um all right uh we'll go ahead and open it up for public comment on this item Mr Chavez do we have anybody wishing to address a board on this item no ma'am at time we have no speakers okay go ahead and count a few seconds do we know uh still no speakers okay um go ahead and bring it back to the trustees any questions or comments on this item seeing none we'll go ahead and take it to a vote trusty Chavez hi trusty kto hi trusty fam hiyo hi and myself I um item 901 update on request for proposal RFP for program Management Services information only uh Dr bow C Mr Chang uh welcome back turn it over to you thank you madam Madam president um for this item um you recall that the

347district's issued a RP for program Management Services um the district did receive um so at this point the administration is requesting um the board to provide some directions in terms of how it wants to proceed with the vetting and selection process um and some options that are possible uh not comprehensive or not limit to that but uh the board can decide to interview um interests during a board meeting or the board can direct staff to form committee interview the firms and bring back a recommendation to the board um those are just the couple options that um that are available but um the board can definitely provide additional one if it desires to do so okay I just Beano's hand up um and staff if you can just kind of remind me I want to say

348that I thought we had given a direction before the pandemic and so um if you can remind me if we did or not on that we had a little bit of direction trusty erera we sent the RFP CA collected people applied and then the pandemic hit so we did not have a specific process to select them so that's why we're here before you to get guidance on that okay trusty Bano yes thank you was it also the case that we didn't receive um a sufficient amount of applicants and and we re we reissued it to get some more options okay and then um I I just want to thank staff for bringing this I know we've I've talked to Dr Bower a few times and I think CA about this there's a number of things

349that we'd like to be proactive on as a district and move forward a number of projects that we'd like to take a look at but we need this program manager to to help us through that process and and someone who does this for their job so we don't burden staff with all these tasks um so I would make the recommendation I think it's important that I think there are six is that is that correct we had six applicants that met the met the requirements so I would recommend that um that we as a board interview all of them in a special session I think it's important particularly for this contract to be very open and transparent about the vetting process and so um I would recommend that we have a special session vet or or

350interview all of the applicants and then make the decision at that point and move forward with that as far as the questions that we would ask I'm not sure if we would generate those at a later date in the interest of time out tonight or if they would come from HR or where but I think we should select from an interview of all the applicants I would second that uh I um I know it's on for information only uh but I see two hands uh vice president GTO yeah I agree um we need to move forward with uh bring on a program manager there's a lot of issues that we need to deal with in terms of uh you know a long list of projects that need to be dealt with and so let's move

351forward and I agree yeah let's do it in a transparent man in in a in a special meeting uh that we can go ahead and hold that can be um you know we can interview them publicly so agreed I think we have um I see your hand trusty fan but before we go I think the only thing and maybe I'm not understanding um you mentioned six applicants uh trusty Beano I would just suggest that we open it up again because things could have changed for some of these um possible uh entities who applied and so to give those an opportunity to reapply I would just say reopening it and then closing it on a certain date um and then moving forward with that interview in public I agree um and being transparent in that process

352um and not necessarily because if I remember correctly it's been over a year that those applicants put their application through U Mr Chang can you refresh yeah close to a year issu in July of July okay trusty fam and then trusty Chavez okay uh you you know uh and I speak from experience you know having been Vice chair of the bond oversight committee I mean uh you know I conc we you know it is best to have the board interview fi finalist for the uh you know uh RFP for program management services but I think that I I I would like to suggest that um instead of interviewing you know if we you know if we go the route of reopening for a limited window uh it might be uh preferable or you know to

353have to have a kind of a middle option which is to have staff form a committee to interview the firms and then bring back say three you know if there are you know say if there are 10 applicants bring back three to the board for consideration because you know uh because obviously we will need staff and expertise in general counsel to do the background checks into vet for which was one of the big things that you know that happened with the previous Bond Man uh program manager so you know I think it you know given that the fact that there there may need to be a sufficient uh background check you know it might be preferable to take a middle position and allow you know uh you know direct staff to form a committee uh

354to kind of do a first round interview and bring back say three three firms for a final round interview before the board thank you trusty fam trusty Travis I think we should do the first round of interviews and I think with who we have we should go with because um we want to honor what they presented in the first place they were the ones that uh submitted and you know we we should look at them first thank you uh trusty wo and then vice president okay thank you yeah I um I thought that the second round of applicants had been more recent than July but if it's not I mean I think I would be open to a limited time opening it but um I I do value what trusty Chavez just said too those

355are the ones that we got but a lot of things for those six may have changed over the course of the past year so you know I I'm not if there if all of those six are still open to it then I would say we go with those six but if there are some that the situation is I also part to trusty um fam's comment I think we had already agreed that staff kind of the first layer of IT staff would UM Vet all of the applicants to make sure that they met all the requirements that everything in what they submitted and their qualifications were all um per submittable or or uh appropriate and those would be the ones that would come forward to us my understanding is that those six kind of did already

356go through that vetting process and they are all appropriate to bring forward so I I do still think that this particular um position and and specifically it's important that we be transparent about the the interview in public with all of them um because of some past history and we just want to make sure that our public has confidence in who we select and the process that we go about so electing them by thank you vice president GTO yeah I think that nothing precludes us from uh asking for a checklist that demonstrates they me qualifications beyond that you may want to ask uh for background checks or other extensive kind of um uh recommendations whatever may be uh to make sure that we're not winded up getting into business with an organization that has a checkered

357pass or a lot of problems um and so I I don't see what um how that would be um if if we do all that and we interview in public which is the most transparent way of doing it we would demonstrate to everyone show everything all the documents are out there I'm not sure how um leaving it up to and I'm not knocking on staff but somehow they're going to be able to resolve any issues that we wouldn't be able to resolve as a as the committee you know we we interview six applicants we've U received background documentation uh any sort of background checks that have been done by our staff and we lay all that out for everybody to see I don't see how why adding a Next Step another layer would would be

358necessary to be able to receive that information present it to the public and then proceed with a very very open and transparent uh process that's so I I'm in support of moving forward with all the applicants we interview them and we come to a decision based on the information that we received from our staff more extensive information than uh possibly we received in the past um and uh yeah I I'm not opposed to reopening it because after a year that list may have gone stale so if um if if it's a will of the board and we're willing to put it out there for a for a limited time you know thinking what two week time frame let people respond and then um move uh move on with it because we do have a lot

359of stuff that's sitting out there that needs to get resolved and we need a project program manager thank you um I'm just checking the time it's 11:24 we still have about 11 20 agenda items left um what I'm understanding is the direction we're giving uh staff um is to go with these six um I I I'm in agreement if those are the ones that applied that went through the process um respecting that and maybe just checking in with them to see you know if um if they are still interested um and then that we interview them in public is my understanding we're all okay with with that um yeah and am I missing anything important before move forward maybe if we like if they're if we check with all six and they're all still interested

360yes we move forward but if for whatever reason some are not there I don't know if we want to have a number like if we have less than three or four or whatever then we open it up for a time period I don't know what that number would be but I think in the case that some may not be interested anymore we should open it up just to have a bigger pool or the opportunity for a bigger pool but if whether that's three minimum of let's say I'll say four a minimum of four applicants if we don't have that we open it up for I don't know what's appropriate two weeks three weeks I don't know what the number the time would be I'll support that same here me too um so I think two

361weeks is good yeah or I mean I'll leave it up to whatever the staff thinks is appropiate we'll leave it up to you are reopen if it's for Dr B were you gonna add something go ahead I believe CA can answer the question whether or not they're interested right CA the six one the six that applied yeah we haven't had any um contacts with um I guess a lot of the the uh vendors um to be able to validate whether all six of them are still interested um after tonight's meeting if the board chooses to move in that direction we will immediately contact all those six um um interested firms to see um if they're still interested in being interviewed thank you so yes and then if four or more say yes and we continue

362if four or less and we open it up again great and we interview in public um all of the ones um okay uh I see no other hands we'll go ahead and move on to 902 wait public comment uh Mr Chavis can you help me out do we have any public comment on this item yes board president at this time we have uh no speakers okay um I know it's on for information only and we'll have time in the future um so if there's nobody to speak on this now we'll have plenty of opportunity in the future um thank you 902 approved 500 onetime payment for CNS kitchen supervisors for using vehicle motion to approve by trusty Chavez uh second second by trusty fam uh trusty Beano you have your hand up oh sorry okay

363change your mind um I'm gonna go ahead and open up for public comment at this time um first Mr Chavez do we have anybody on for public comment no public comment at this time okay I'll count a couple seconds do we know uh still no comment okay seeing none I'll go ahead and open it up to trustees questions comments concerns this item seeing none we'll go ahead and open it up for tro just quickly I'm GNA support this and I want to thank all of our staff we've already talked about this but everyone who's G gone above and beyond on their own I know you mentioned it earlier tonight um president and so thank you to to our staff who who are the real heroes here and and I'm going to support this thank you

364um and with that I'll go ahead and open it up for the vote uh trusty Chavez hi vice president kto trusty fam hi trusty hi and myself I moving on to 903 approve 500 one time payment for CNS kitchen supervisors move approval motion second move to approve by vice president GTO is that correct yes correct second by traveis um okay I'm GNA open it up for public comment at this time Mr Chavis do we have anybody no speakers Madam president no speakers count a couple seconds do we now uh still no speakers okay uh bringing it back to trustees uh trusty Bano oh I'm sorry again man you're fine okay seeing no others I'm gonna go ahead and uh um go to voting trusty Chavez hi trusty hiy fam hiyo hi and myself I all

365right moving on to 904 approved non Duty day payment for S administrators and one it supervisor up to five days motion motion to approve by truste second by trusty Fam I'm going to go ahead and open it up for a public comment at this time Mr Chavez do we have anybody wishing to address the board on this item uh we have no speakers at this time okay and being that we waited a couple seconds uh already um we'll go ahead and come back to the trustees any questions or comments by the trustees tryano yes U thank you just really really super quickly I I know I had some questions on this initially but I found it helpful for Dr bow to just give a brief explanation of what this is about so um if Dr

366B if you could just give a very brief explanation of why this is here and why it makes sense this were all the set administrators that needed to give up some of their non-duty days during the spring break to get us ready for reopening including the it supervisor one it supervisor so I'm asking the board respectfully to honor that because they don't have enough days to make that up thank you thank you and with that I'm going to go ahead and uh turn it over to voting at this time trusty Chavez hi vice president GTO yay trusty fam I trusty wano I and myself I passes unanimously moving on to item 10:1 approved three-year exposion plan between Alam Rock Union Elementary School District and Santa clar County Office of Education motion to approve motion by

367second second by vice president kto um I'm going to go ahead and turn over to public comment at this time Mr Travis do we have anyone uh no public comment at this time I'm going to count a couple seconds do we know and still no uh okay raise hands thank you um I see your hand tryano but I will comment that this one you know kind of put me at a halt and um I did talk to truste trusty to H superintendent Bower about um you know the details on this and um as an elected official I look forward to uh looking into this further because I don't think um you know our students should be getting expelled so um I will be um looking into this further I know it's a part of the

368you know uh law and it's a process that we do um but yeah so there's so much more to this one but that's all I I'll say right now trusty Bano yes I I had I mean I think maybe different questions or concerns than you but I did have some for Dr Bower um and she specifically Ally kind of um as an answer to one of my questions explained how there's kind of two paths that different students can go down in in terms of this item so Dr Bower um can you again briefly I'm putting you on the the spot here but just give a brief description of how two different students may go down two different paths depending on their their needs their behavioral needs and and things like that so we are a

369follow following it code all districts have to submit their plan for uh to this to the County Office of ed students with an IEP they follow a different uh route because it especially it has its own uh legal criteria about following up in terms of discipline so that's the the One path students who are not um don't follow on those very strict special ed requirements and they follow into this in alumrock we haven't had an expulsion for seven years so um basically you know we are just following uh the law submitting our plan thank you thank you and the other thing I had very quickly is that on page five um I'll just ask staff to look at this I talked to Dr B already but they're at the bottom is of page five where

370where it says Alam Rock Union Elementary School District existing plan for expelled youth there's three items that are numbered sequentially one two three but that's not necessarily any order so it doesn't mean that number one is the first step number two is the second and so forth so I would just suggest the staff look at potentially making those bullet points as opposed to numbers because they're not sequential and and as I read it that makes it seem like those are steps in a process that's not I guess accurate um so that's my only other thing thank you thank you um okay moving on vice president yeah um just with regard to the plan and understand that it's a document that needs to be in place for to comply with the law um our our district

371has taken an approach to not uh disregard their children or not discard children um and so I'm very very proud of that um however in those instances and I've said it before and I'm not going to shy away from it uh where you I I would I would have to um make a decision based on you know would I have a child that's doing certain things next to my own child um and that's a that's that's what I would have to do uh in order to to come to an assessment I wouldn't place if I wouldn't place that individual that's doing certain things next to my own kid and I wouldn't do that for any anybody else's kid and so Dr bar mentioned the last time had to do with well I I won't go

372into that but um the the the we've taken great steps to make sure that we don't um you know just push away our kids here at Alam Rock and uh it has to the issue has to be where they're threatening somebody's life or something like that that's that's a pretty you know significant thing so I just want to make sure to mention that for the for the uh for those from our our colleagues who haven't been around and haven't had to deal with the expulsion it's due to the fact that the the the district has invested heavily in looking into ways to to support our children rather than just simply expelling so thank you for your time thank you um okay at this time um we'll go ahead and move for the vote uh trusty

373Chavez hi trusty kto hi trusty fam iano I and myself I okay move moves unanimously uh moving on to item 1101 uh approve resolution 45221 to Second by Chavez uh I know that it was read to us out loud in earlier in the meeting so we'll go ahead and uh go to public comment at this time Mr Travis um at this time we have no public comment okay and being that we had time earlier for that um we'll go ahead and come back to the trustees any questions comments concerns okay move to vote trusty Chavez hi vice president kto hi trusty fam I tryano I and myself I moving on to 1102 second move to approve 40 2021 resolution number 404 I'm sorry uh I motion motion by fam second uh Mr Chavez do we
