003item 601 we'll table that any other changes modifications okay seeing none uh we'll just uh table item 601 and we'll move on to uh special presentations uh item 2011 racial Equity committee presentation I'll pass it over to you Dr Bower thank you and I want to welcome principal Nan and Miss Dalton they are the leaders of our rachal Equity committee and they have an update for the board marel I think they're in the audience and and we need to let them in hello welcome hello good evening board trustees um I believe my wonderful uh co-presenter and Co lead is still out there there she is okay can you hear me good okay great thank you you're coming in clear miss tton all right and um Miss uh Kio do you happen to have the presentation

004to display or would you like for us to share our presentation can you share your presentation oh sure absolutely thank you we can we can absolutely do that you could just give me a moment okay Dr Bower and board trustees do you see my screen okay yes okay excent I see head nods wonderful all right well um good evening board trustees uh Dr Bower um Madame President Karina Herrera Laura thank you so much for having us this evening and we're so happy to be a set part of the board meeting agenda to be able to discuss our um our conversations our progress and our next steps as the um arusd racial Equity committee um I would like to start first by grounding our group in in our draft Vision as a team uh by the

005end of the 2022 and 2023 school year we believe and hope that our work will lead to our all of our alen Rock students feeling proud and confident about their personal identity and feel joy and learning due to all of our intentional efforts to engage in anti-racist work including culturally responsive pedagogy decentering whiteness in our organization and essentially um engaging in transformational social emotional learning when we engage as a racial Equity committee we often offer these conversational agreements to support each other with our own growth and be able to develop and Foster psychological safety and as was mentioned in an earlier board meeting we aim to keep our initial pilot year um as closed meetings to allow our group to develop strong relationships amongst one another as one might um perceive you know a retreat

006setting to be to allow us to engage in these courageous conversations that support us in delivering upon work that we understand is very essential and important to the district that being said I'm going to pass the mic to miss tton who's going to leave lead us in our land acknowledgement thank you Anna and we do open all of our racial Equity committee meetings with this so I want to offer recognition and respect to the MMA aloney people past and present who were skilled hunters and Artisans as District leaders in racial Equity we acknowledge the Eraser of indigenous peoples and honor the presence of the original caretakers of this land upon which we work and live we are committed to standing against systemic oppression and working towards racial reconciliation back to you Anna so the purpose

007of our presentation this evening is to give folks an idea of what it looks like to be a part of our conversations as a racial Equity committee but we also hope to offer the macro lens of being able to share um General understanding insights that our team has come up with to support us with our next steps and our partnership with the district so that being said there's a typical structure that we align with I apologize I think I hear an echo okay thank you um there's a typical structure that we follow to um that is aligned with um Castle sign practices of incorporating welcoming activities uh engaging activities and optimistic closures to again maximize our team's um social emotional connections and psychological safety and engaging in important conversations and in this particular um meeting

008that we had last month we focused on analyzing the fall Panorama education survey data and um we understand that the spring data is now available so when we meet again next week we're going to analyze the spring data moving forward uh we want to also reintroduce who is in our racial Equity committee group and I do want to acknowledge all those who are volunteering along with us to serve in this important work in our district I'll acknowledge each of them Aden goldb FL de jacobo Selena Ramirez Catalina Rodriguez Joseph manuco Vanessa Kerr dman MacArthur Milton casturi Basu Winnie sh Danny Sanchez Michael T Jason sorage on the next slide you will find a quote Carousel and these are quotes from two anti-racist Visionaries patina love author of we want to do more than survive and

009Robin D'Angelo author of white fragility why it's so hard for white people to talk about racism the members of our racial Equity committee examined the statements on the slides and other messaging to determine our own biases and ways to disrupt learn patterns of behavior we acknowledge that it takes work that is uncomfortable at times to dismantle white supremacy next slide please back to you Anna thank you Miss tton as a as a racial Equity committee that is um fairly new and now entering what is going to be our third meeting following in the next week um we wanted to start first in grounding our work in data that that we understand is very important for our stakeholders and our district leaders and our school sites to examine acknowledge and move forward from we have partnered

010as a district with Panorama education since approximately 20 17 to collect input from staff members students and families regarding perception of school climate and as a racial Equity committee we perceived that it was important for us to work from historical data and be able to collect new segments of data that would be relevant to our work with regards to diversity inclusion as well as cultural awareness and action as a as an entire District team so when we reviewed this data which was um you know thankfully uh disaggregated for us along with um our U Partners in Panorama education and along with um the director of our state and federal department Miss Andra Garcia uh we were able to pull apart data that allowed us to closely examine our students experience and perspectives in relation to

011sense of belonging and um other areas that we perceive are important for racial equity and inclusion so again um we as a group reviewed the fall 2020 data and the fall 2020 data um involved 29 schools 2,900 students and six topics that are um relevant to our historical examination of Panorama Education data as a racial Equity committee um understanding that there's six categor ories what we focused on specifically were sense of belonging school connectedness because we perceive that our students can um feel at their best and do well and embrace their identity and engage in joyful learning if they feel like they belong in the school whether it's you know physically or through distance learning we also examined diversity inclusion data and cultural awareness and action um the latter being also offered um from a

012staff perspective please note that the last two categories I mentioned are um designated for our Middle School levels given that our students most likely have the more advanced um Consciousness and vocabulary with regards to those categories we do we do want to note that the survey only uh was taken by less than 50% of our population and knowing that over the few months in between the fall on the the spring survey we uh we as I I know that our the principals um staff members worked really hard to get the word out there to ensure that our families and students knew about this opportunity to have their voice heard there we go so um something to note about the survey data so um there there's an interesting um way that we can see this data

013in which um students what's really unique about this data and I'm sorry the survey overall is that our students get to fully represent their voice from the identity that they um categorize themselves um highlighted in Orange are the ways that students identified themselves um by race and or ethnicity they also got to identify their gender or their sex and so for example Le um there is a category in which students can say I'd rather not say as opposed to often to male or female this differs from our um you know our systems um that are offered through um sorry uh I'm losing the word for that the our Master systems for data collection as a School site and as a district because it allows our students to be able to identify um exactly who they

014are um through this external resource overall we want to share that this Panorama Education data really matters to us because we get to see how students um we get to see students social emotional learning skills and we get to identify Trends between social emotional learning and attendance we get to also identify Trends between social emotional learning and their outward behavior and we also get to um connect social emotional learning and how they do in their cours workk um it has been identified in multiple studies that have been provided by Panorama education who has initial ties to the Harvard School uh Graduate School of Education that students who have um a higher sense of self-efficacy and sense of belonging are more likely to do well and have better grades and so we we want to see

015that overall our theory of action as a racial Equity committee is that if students feel like they belong if they feel like their identity is honored if they feel truly connected to the people who work with them and the students who are working alongside them that they will be able to engage in academically rigorous courses and be able to perform to their full potential and now I'm going to pass the mic back to Veronica thank you this slide um again identifies the three categories that we closely look at as a racial Equity committee as principal n has already mentioned and those areas are sense of belonging cultural awareness and action and diversity and inclusion next slide please you'll see the elementary results grades 3 through five and these are students who completed the fall data

016survey and it yielded the conclusions about their own sense of belonging those who responded did say teachers treat them fairly at school 89% responded with that and finally uh if they felt close to people at school that percentage was 55% now to the Middle School results this slide has data again only for those who responded 81% responded favorably that they are treated fairly at school by their teachers while 52% said they feel close to people at their school these seem to mimic each other from elementary to middle school now cultural awareness and action you may not be able to see the question that's underneath that I will read it how often students learn about discuss and confront issues of race ethnicity and cultur and cultural culture in school excuse me so this data suggests that

017only 21% of respondents felt that conversations about race occurred the research concluded that 71% of those completing the survey felt that their schools Empower them to speak out Against Racism and I do want to take a point of personal privilege here to acknowledge that all middle school students in our district were given the opportunity to participate this year virtually in the 1619 club which is a black history and Social Justice Collective we've met virtually since September and I'm especially proud of the strong community that our group has built and the leadership potential that students have developed as Club advisor I'm still open to receiving new members and I want to acknowledge its Inception in 2019 by principal Tera bford at Joseph George Middle School where I teach next slide please now for the staff and

018employees this slide reveals that the employees perspectives on Race ethnicity and culture in our schools is somewhat not as favorable only 14% of respondents describe that that conversations on race and ethnicity occur when uncomfortable and there are many times when it's not comfortable um the survey inquired about the frequency with which colleagues think about the experiences of employees who have a different ethnicity and 43% said they feel that that that is done our committee work is grounded in the belief that we can Empower Alam Rock staff and UL Ely our students with tools and resources to develop these communication skills next slide this one has diversity inclusion uh for middle school students grades 6 through eight and the results were relatively high with the respondents in this category being assessed on how diverse how integrated

019and fair school is for students from different races ethnicities and cultures you'll see at the two highlighted sections 88% responded favorably that adults at school treat people from different races and ethnicities well and 82% responded that students at the school sites treat people from different races and ethnicities well this are these are positive things and now I will turn it back to press p in thank you misson so we we looked at categories that we feel are important indicators of sense of belonging joy and identity and joy of learning uh we also want to look at the actual ethnic breakdown or racial breakdown of the responses and if I could attempt to describe this as eloquently and succinctly as possible it's my understanding that the gray boxes at the top represent all of the respon

020respondence um uh all of the respondents responding favorably so all of the respondents Just aggregating all students together regardless of racial groupings um all of the respondents said that 80% of them said that the climate of support regarding academic learning uh was favorable 84% said that they felt like the rules of the school were Fair 72% said they felt safe at school and again the point of um analysis for our group 78% said that they felt connected to the school now when you look at the categories below it identifies what the percentage is for students of a specific racial or ethnic category so if I were to for example look at the Filipino Group which is actually disaggregated from the Asian group it seems as though our our students who are identify as Filipino um

021would respond 5% above that overall um favorableness so um 78% plus 5% so typically the Filipino subgroup identified that they are um they're 80 83% of them uh feel uh like they're connected to the school and then the uh and then conversely the same is true for um students of a different racial category of say for example the American Indian or the Alaskan natives who identified a minus 14% from what the average States so we see here that there is a uh there is value in disaggregating our students experience by racial or ethnic group because it allows us to um be able to see from their perspective and perhaps further inquire and investigate why that is so we can perhaps learn from the positive experiences and also learn how we can do better for all

022students involved this one um the previous slide was in relation to elementary school and this slide is in relation to Middle School um again if you just take a moment to look at the specific subcategories we do see um that there are um different levels of experiences that are reported back by our students of different ethnic groups for example if I were to hone in on um the black or African-American student subgroup we see that there is um a plus seven um over 49% on the belief that U black or African-American students perceive that there's cultural awareness an action that's being done by the school site with regards to um social justice issues but then there's a minus 7 within the same subgroup with regards to diversity inclusion so minus 7 to 75% um we

023have 68% so uh again probably worth observing and noting there's also an opportunity for students to share narrative uh feedback and love reading this part of our Panorama education survey data because it allows our students to speak in their most authentic voice around what are two things that the school can improve and what are two things that they they really enjoy about the school so um in this first category of what they feel we could improve these are word clouds so word clouds are for those of us who are newer to word clouds um they essentially pick up the words that are most rep represented in the qualitative data um that's why you might see some interesting contractions there with the apostrophe T's but um but you see here in the elementary school level um

024our uh third graders to fifth graders um feel like the playground could be improved and the bathrooms could be improved and the swings could be improved I think things that have to do with external facilities it seems and homework I think homework is often a thing that students like to improve or if not eradicate um and then Middle School we do see that um uh you know as one can see rules is something we can improve food people's very general homework um so um in order for us to see what this word cloud really represents what we do is we then look at the the qualitative uh responses um School principles and School staff often look at these responses to see how they can adapt to the student feedback to essentially act on it so

025something that we really wanted to highlight is um they actually students actually noted um not just what can be improved but what has been improved so in this first response um students noted that as this survey is the first survey that we delivered during distance learning in the middle of the pandemic because the spring survey closed last year before the pandemic hit our our districts um this student noted that we put mental health health first and we provide social emotional support um and they would also like to see us help them think about their future such as with their careers another student noted um that um and and I could read this response aloud because I think this is so powerful it says some students are already on this but maybe for attendance put their

026pronouns or put their name trans people prefer and not a dead name my friend had a breakdown because he just wanted to stop being called his dead name they are trans I can't think of a second Improvement but otherwise our school is doing pretty well so we see that students are advocating for um for pronouns that that essentially support folks with being able to express their true gender identity um and then this last piece of feedback here um for me probably helping out people with bull like calling parents or finding the source of the bully's Behavior even though I personally never have been bullied as far as I can remember make it easier for people who don't speak English to communicate like putting someone who speaks that language next to them so they can learn

027for example this students already thinking about how to be a stronger advocate for other people knowing that they already benefit from within the system we can see Within These strong qualitative responses that our students know how to think about other folks which is a wonderful thing again the second form of qualitative responses that students can provide is what should we continue and City year if representatives are out there you got a lot of love from our elementary school students our students absolutely enjoy being supported by you during this time and we want to give you a big Kudos because we know that as one of our after school program providers you have been at the front lines from the get-go with our care pods so thank you to the city your folks out there our

028students see your work um with regards to um things that folks should continue in Middle School um we see good teachers we actually see homework here too so um and we actually see distance learning somewhere out there too so uh we do uh want to look into what these responses look like um one by one so uh this qualitative response seems to relate to City ear so two things things in the school that does well the first thing is the teachers in the school because they're helping our mind grow and grow every single grade the second thing is City ear because they help you get extra work and play in the playground when it's fun Friday and they let you play with stress toys when you're stressed the second response is the teaching is one

029of my favorites I love how my teachers try their hardest to help us learn I also like how my my school everybody treats each other with the same rights third response providing for those who go to school with low income they provide a lot for those who can't really provide for themselves communication is also really well I suppose when someone needs to get into contact with the administrators then they just genuinely contact the office and they answer really quickly I think I just want to pause to give a shout out to all of the office staff out there again who have been back in the offices since May and especially our school linked Services coordinators that are attached to our student services department the this response is alluding to the work that our students see

030is being done behind the scenes and we appreciate you so much and then the fourth response here having an organized schedule it really helps me remember the Stu the schedule easier number two providing resources for students it's really helpful for students that can't afford to go to the store because of the pandemic and again the students see the work that's being done behind the scenes they see that their parents and they are being served by the uh resources that teachers connect them to that office staff connect them to that our schooling Services connect them to and it's wonderful to be able to see this represented through our student voices and I'll pass the mic back to Veronica to speak to our team's conclusions all right thank you um this is um kind of the end

031and and we want you as community members as school board members as employees as staff parents par students to reflect upon what we shared today what did you notice what did you wonder about the findings with sense of belonging cultural awareness and action and diversity inclusion um I want to highlight three areas that our racial Equity committee identified after the first analysis of the data the impact on students how can we improve wraparound or holistic services to implement and support social emotional learning that was the first secondly the impact on adults how can we engage adults in having uncomfortable conversations even those not surrounding race to reduce the stigma or discomfort and finally considerations the information presented does not really give a complete picture of our students experience es a number of us on the

032committee work with students who typically experience marginalization that's the truth and knowing that these students may not have completed the survey we want to amplify their voices in a future Town Hall um Anna will share final thoughts thank you Veronica for sharing our thoughts and considerations as a team as an as a racial Equity committee our next steps include one making sure that our work is happening to support the work that our our district leadership is already committing to and is already um is already hitting the ground running with um we we work um with closely with our academic Services team in which Mr Jason sorage is a part of our racial Equity committee as well and we also work closely with Miss Sandra Garcia the director of State and federal who supports us with

033analyzing and collecting the Panorama education survey data our goal is to continue working with them and also increasing our frequency of working with them to ensure that starting next year we have a solid umbrella plan that allows us to be able to think about one what does it look like for School site leaders to be able to analyze this data and be able to bring back this learning to school staff and what does it mean to bring back uh bring anti-bias and anti-racist professional development to sites uh whether it's through teacher plc's or directly through site principal partnership and collaboration our second step is to meet as a a core group next week to discuss the spring Panorama education survey data and I understand that Miss Sandra Garcia will be giving us a sneak peek

034of that through her lcap presentation later on today and once we get to analyze it as a group we'll be able to present our findings and our considerations uh to board meetings from now and lastly um coming back to what Veronica stated um we we understand that surveying 49% of the students is not all of our students and it's most likely surveying the students who we know will will be able to complete the survey within um a set environment such as their teachers morning meetings and we know that there's a number of students that opted out of taking the survey and we want to be able to hold a town hall that allows us to consider the multitude of voices of our student population across the district and we aim to hold this town hall

035on May 18th um from 6:30 to 7:30 in which we will hold this hold a panel for these students and ask them questions in relation to uh the data that we collected overall we aim to attach narratives to this quantitative data and hear their voices Elevate them and help us think about this work in relation to and for them and that concludes our presentation as a racial Equity committee thank you so much board Trustees for your time um Dr Bower and audience members we appreciate you listening in um and please let us know if you have any questions thank you so much for such wonderful presentation um Dr bow was there something you were going to add before we um okay just want to double check I saw your mic uh come on um so

036at this time what I'll do is open it up for public comment and then we'll go to the trustees for any questions and comments um I see Mr Moran on here um Mr Moran do we have anybody that's raised their hand this time hello good evening board president uh we do have one person we have Dan D Ambrosio great welcome Danielle as soon as you begin speaking our timer will begin no um I'm I apologize I I wanted to speak about a different matter did that I I thought lower hand meant like my hand was lowered okay thank you for clarifying yeah um so just to um let you know right now we are on this item um if the item that you are here to speak on is on our agenda then um you

037can wait till that item and if it's not on the agenda you are able to speak on the um right it I apologize I thought my hand on my screen said lower hand I apologize no problem welcome thank you so much uh Mr Moran anybody else that might have raised their hand at this time I see no other uh members from the public okay great thank you um at this time I'll open it up to trustees any questions comments uh Mr Beano I don't know if I should direct my attention to you here or right over there I see you probably be a combo as I get used to this but so thank you um first of all thank you to the team for the really the thoughtfulness of of the work that's going on

038it's what I like about it is that it's not really just like a um you know cookie cutter boiler plate approach I like that you know it's very clear to me that there's a lot of introspection and strategic thoughtfulness going into this so so first of all I just want to acknowledge and and thank the team for that um the second comment that I wanted to make is just that um I'm encouraged all by the the comments that were made about the the staff and kind of in the future I think I heard um discussion of how we'll facilitate some of those courageous conversations and and how we can get people to engage and so I'm looking forward I'm just based on what I see I'm confident that yourselves and the team um Miss D

039and Miss Talton will will will do this but I think it's going to be really important to to nurture and and create a a safe space for those who may not agree I think we're in a time um culturally politically where whatever you want to call it where many people kind of feel like it's black or white like you believe this or you believe this and there's nothing in the middle and I think that that is what sometimes can create a sense of people who may have questions or may want to understand more don't want to speak out and and say something because there's consequences for that so it's a difficult task but I'm I'm like I said I'm confident from with what I see and then the last one that I had is just

040a question back on the the comparison slides and so um you know we talked about some of the kind of like the um the more what's the word not distinct but the numbers that were kind of more of outliers for particular groups um native Hawaiian other Pacific Islander um American Indian Alaskan native and so I was wondering do we know I guess it would be try to think what the denominator is for those how can the way I explain the most clearly I think is that the numbers that appear to be more um have more variance from the mean or from that all respondents number appear to kind of be those populations with less of an N less of a total population so I'm wondering if part of or maybe some of that is just

041because the numbers are smaller than any change in any direction makes a big bigger um you know impact on that total number so I'm a just wondering if if that has been thought about and and if not if it's something that could be kind of fleshed out a little bit as you continue to work with that but it's very helpful like I like the the way the data is presented so that's the question I'm not sure um am I allowed to respond to board member okay yeah um trusty Bano you bring up a very solid point and I think the way that Miss tton and I want to operationalize racial equity and Justice is regardless of the group size we want to take into consideration that um you know with those smaller subgroups that we

042understand are dispersed across the multiple School sites we acknowledge that their experience might be largely different from others and we hope to create an environment with we students within those subgroups in which they feel more marginalized hopefully feel more included in the in whether it's instructional programming or the culture of the school um I agree um trusty Bano it's worth investigating and it's worth acknowledging it's our hope that that town hall can help us bring some of those voices to light to help us learn more may I add really quickly that we do hope to have every racial ethnic group represented in that town hall and um we are still accepting students so if you have any uh teachers principls we do have a Google form and we would love to get their information so

043thank you very much thank you both thank you um I do see uh vice president gto's hand up um if you w to make your comment or question and U just uh wanted to thank you for you and the committee for the excellent work that you did uh on my and then the excellent presentation very much appreciate the the uh quality data that you've provided us and I know it's going to help us as we uh go ahead and make decisions uh on behalf of the students staff and everybody here at the district thank you very much thank you uh trusty fan uh yes so I I too would like to commend principal n and Miss uh tton for presenting tonight uh uh I know you you you guys have done a lot of work

044on this already and there's still work to be done and I do look forward to your final presentation to board meetings from now uh the one other thing I'd like like to say is that I am very pleasantly surprised at the level of of how articul some of the student respondents uh you know their responses to the question then uh trust me I I don't think that I don't think if I were kid in elementary school or even in middle school I would have thought thought of those things in that way so I'm uh you know very pleased that you know our our students are maturing uh a lot you know progressing on that a lot faster than you know I've encountered and I certainly thought so I am very hopeful that uh this work

045will lead to a a much better learning environment for all our students so thank you very much thank you trusty Chavez anything you would like to comment or ask before I give my comments thank you um so just to re iterate thank you so much for such detailed presentation which means that you did a lot of work you know and we can see um with getting the surveys out and um I'm really excited to hear the student Town Hall about student Town Hall um opposite to Mr Fam I'm not surprised about the answers because I have a 12-year-old at home that is a student in our district so I get to hear her every day and I'm like wow right and um so I look forward to encouraging her to attend and um speak there

046along with the you know rest of our students um for me it's important to hear directly from them um since you know we do our best as adults around them to make sure that you know they're learning and thriving and um feeling good about being in school and of course it's important to um feel good and feel connected in order to learn the rest of the things right that they that they get to learn um while uh attending the classes um and listening to their teachers so thank you for your work very important work um and I look forward to continuing to support um and I just have one question and more on the personal side you know um I am familiar with a little bit about your stories and um the background and the

047work that you've been doing prior to this um but was there anything that surprised you you know I know um there was some passion right to be where you're at um but after doing you know where you were at in the beginning before we set this uh committee to now is there any surprises um that you've had either one or both I haven't had any really um but I look forward to learning more about racial equity and allowing the students as I mentioned to be empowered and be the change agents and you know inspiring adults who may be less inclined to talk about uncomfortable conversations and I feel that the children children can they have the capacity to do that thank you yeah I I think speaking to what I'm surprised by um I was

048surprised about the adult data that was available I think I think you know post um you know post a killing of George Floyd I think a number of team members cross the district um I felt were very vocal and on on board with black lives matter um there was a movement in in which we all joined together for racial Sol uh for solidarity on behalf of racial Justice and it it was surprising me to me to see that folks still felt as though we we did not yet have the tools to engage in those conversations in a professional setting and so I I it I think it further ignited the fire for our work knowing that the hearts there the passions there I think it's just about fear of you know stepping on people's Toes

049or fear of saying the wrong thing I don't perceive that Folks at all especially working here at the district I perceive everybody here is deeply committed to Justice and serving our students well I think in terms of our our training and our pedagogy and understanding how to speak about racial Justice in a way that our students can comprehend and in a way that demonstrates the collectivity and solidarity that um I understand um you know this whole board is committed to um I I understand that we have some work to do thank you and before I give my last comment I want to give trusty Chavez the opportunity I see your hand up trusty Chavez uh yes I did have a question um uh one of them mentioned that they wanted to hear about positive feedback

050and can we also ask the students about if there is any negative feedback if we can also hear from that side because I think to be well informed want to listen to both sides that's it thank you thank you trusty Chavez and the last thing I'll say is that uh I am very glad and thank you so much for um I know Miss Talton you mentioned that you opened up all your meetings with the honoring of the First Nations people the moek Melone um and you know I I am personally agree 100% you know and that um there was a time where they were tried to um the you know they were they were they tried to erase them um the tribe and so um being indigenous myself is important to continue to honor um

051the indigenous people especially of this land um and also my daughter right when she hears that like you know that she asks questions and you know then her friends want to learn more and so um yes I I just wanted to um mention that point thank you again for doing that um and if there's no other questions or comments um trusty Chavis I don't know I see your hand up I'm not sure if it was already from the comment that you mentioned earlier or if you still have another questions no okay thank you so much uh for presenting and being here tonight we'll go ahead and move on to uh item 202 local control accountability plan um the initial findings of the presentation uh Dr Bower GNA ask Sandra Garcia to present this to the

052board welcome Miss Garcia and I'm assuming we have the presentation up and ready to go let me screen there we go all right board president Lera and um Board of Trustees Dr superintendent Boward um my name is Shandra Garcia I'm director state federal programs I'm here this evening to provide an update on our progress on the local control accountability plan and this evening I will share some initial findings with all of you uh my objectives for the presentation are to share some information on stakeholder input some of the trends and findings um that came through in um through the forums uh and the input sessions that we had and some survey information tied to the elap goals I know you already heard some some survey information that were more related to um Anna and Veronica's

053presentation mine will be more uh related to the lcap goals in um in general uh and then share the next steps from the elap adoption process just a reminder of the timeline um our goal is to uh approve to have a public Hearing in June um and approve the um the lcap for 2021 2022 so just a little bit of background on the type of stakeholder input that we gather um the stakeholders That We Gather input from are the parents and and community members um the our staff members arusd staff members um our students uh our Union groups and our management team and the Way That We Gather the input is through a variety of of methods we um hold our annual um forums um with our community which we did have this year uh

054in March we um have Advisory Group meetings with our daak our deac and our elcap advisory committee um we have school site input sessions where every school um has an input session with um their community and their staff and and students and they also are able to provide input um a site basis then we have our surveys in which our parents staff and students participating um I thought it was important as I was looking through um the various um comments in our um survey as you saw earlier Anna and Veronica mentioned um that we do provide parents and students an opportunity uh to answer two questions at the end of the survey and they're open-ended questions and um I just saw some really nice things um coming through in those comments and I just thought

055it was important to point some things out especially during this challenging time of pandemic and everything that we've been through um you know just for people to hear that they are appreciated by our family and our students and just some of the things I heard were you know that we did a great job in addressing the technology this year the Hub of resources was very helpful to people um uh parents and students appreciated the the staff and teacher check-ins with their students every day and to see how they're doing they felt that that was really important and these are comments that weren't just mentioned one time and that that's the reason I chose them was because it was a variet you know know a variety of parents and students that that made these comments or

056something close to it and so um one in Spanish you know just appreciation of all of the support that we've given their families and their students during these difficult times and then you're doing an excellent job so I just want you know sometimes we don't feel like um we hear these things and I thought it was important for all of us to to know that these things are appreciated and the effort is so I'm going to move into um some of the Middle School um input um want to thank imy Alazan Dr imy Alazan from um state and federal she um was able to hold input sessions with our middle school students and um we able to go through the different comments and and input that they provided and um connecting them to the four

057goals from our elcap and in general I mean the the students um as someone mentioned earlier you know they're able to articulate what they need and what they feel is important and I did highlight in in white you know some of the the common things that that came across you know during these input sessions and in the notes that were provided from them and you know they were around the the various educational apps and the tutoring support and and type of support that they feel is important for their learning you know providing support to our English Learners making sure that you know um we provide seal time they I mean that came out through almost all of these um these goals and the input sessions is how important that social emotional learning learning time was

058for them um this past year and I think I saw that more this year than I did last year and I think it's because we did focus on that a lot more this year and and they're they're appreciating that and they're wanting more of that so um I wanted to highlight that and um the fact that they really liked the teacher office hours um I think they felt that they were very supported during those office hours and had the opportunity to to really connect with their teachers during that time and then the advisory class you know keep the advisory class is what was said you know it really they felt that it was a good time for students to connect with one another um in a way that is non-academic so um I thought there

059was some really good comments and input by our middle school students um some of the trends and findings from our forums um it's very similar very similar to what the students are feeling and needing but again um I saw some important themes coming through uh with our our parents um talking about things that we did during um distance learning that they really like and they really felt were supportive to our students and so I just feel it's important to point that out as we move forward and make plans for the future on you know keeping some of these things or considering um keeping some of these things so the student platforms I mean that was something that was mentioned over and over again how important that was for their students and their learning this year

060and their success um the morning meeting people loved the morning meeting they thought that was a really important part of the day and the way that it was um connected to social emotional learning uh they feel that professional development as well as training for parents is important in the use of technology and the platforms um uh and that came through over and over again and um the big one was the the mental health and uh counseling services um mentioned many times throughout the forums and even the surveys you'll see that as well um and as well as training for parents in that area both areas of social emotional learning and mental health um one of the things I saw a lot too uh was uh how people appreciated Zoom and comments about how they really

061want to see if we could keep that platform as a way of um providing access for families who cannot make it to the school sites even when we're back full-time um on site you know can we keep that as an option uh for for meetings in the future and also how important parent Square was to them in terms of communication so really important and good information from families now here I just broke it up it's the same information you just saw so I'm not going to go over it again but it's broken down by goal and how it connects to the goals and I just shared this information with you now I'm going to jump into some some survey information and again this is um in relation to um the lcap the four lcap goals

062um and I put here the information on who took the survey and um comparison from last spring when we were full on into the pandemic and I think um we we took the survey maybe a week before I think it ended maybe a week before we um or maybe during the time when we um shut down and went into distance learning and then this year um still distance learning but we were still able to get um not everybody of course to participate but we're still working on that piece and and trying to find ways to get more um involvement from people in the surveys um this is some overall information [Music] um for the different stakeholders and um I think overall I think the staff and and parents are in a little more agreement in

063terms of um some of the the results um you know and safety and um sense of belonging you know being a little bit lower but then you look at the student and I think you heard that in the last presentation um when it comes to safety and sense of belonging you know we have some work to do in that area and I have some other information in future slides that um when you really drill down into the the data I believe that it's not that students don't feel safe in the physical environment I just think there are other things that we do need to work on um to help them feel more connected and safe among their peers in terms of maybe some bullying that might be going on or um teasing or or not

064being accepted by others and so I think that that is where that's coming from just in me drilling down and looking more into into the data but overall um these are the the results from the spring data um and I again I connected it to the main buckets of the lcap um and so I selected some different um snapshots uh from the survey to connect to support for academic learning in this slide um again you know when it comes to academic learning it seems that you know staff and parents really believe that we um do have a positive learning environment for our students that we have high expectations for them and quality of instruction is there and students still have very um uh good remarks about the academic learning environment um but I'm going to

065share something interesting with you and you're going to see it in the next slides as well is that it's not necessarily that kids are our students are um saying that this is not happening I think a lot of them are very neutral in in their responses and this I'm going to share the next slide with you so that you see what I'm talking about um again in safety staff and parents you you know they have higher um marks you know 80 high 80s to 90% in terms of um student safety and how students feel um on campus and if they feel students are safe and then when we go to the students in elementary it's 77% and middle school 73% what I want to point out here is that that's the amount those are the

066students that feel very safe or safe and then we have about 8% in elementary and 6% in middle that say they feel unsafe or very unsafe but there's this middle area here and I think that's where uh we need to drill down a little more and figure out you know they say they neither feel safe or unsafe so they're just not taking they're not taking a stand on how they feel they maybe they're not sure how they feel um so that I think it's really important to point that out that it's not that kids aren't I don't want to say that they're not feeling unsafe they're feeling unsafe I just want to say that there is that middle area of students that um we need to do a little more investigation on okay um oh

067School connectedness similar to what I said mentioned before in terms of staff and parents feeling like um you know Staff feel connected to their work environment and parents feel that they're treated with respect that they're welcomed at school and you know very High marks for that and then you go back to students again and you have that middle that middle group of students that yeah yes some of the time I feel that way but then when you go to no never it it's it is I mean it's significant that's 93 students but it's not as high as 880 that do feel part of the school all over the time so again I think we need to drill down into these little these mid areas these NE more neutral areas and see um a little more

068of what's going on in those areas so um back to those um questions that are asked at the end of the survey the open-ended questions I did pull out some things that I thought were just important to point out that um really um support what I was saying earlier about the mental health and the um the extra support that students and parents want for their kids the the apps and um technology um you know just this first comment final ideas about how to improve this school and a parent said please bring more Mental Health Services my daughters are struggling with anxiety and need support before making the transition back so I thought that was really important and then you know you had some parents saying you know please continue to provide online classes While others

069were saying let's get the schools opened in a safe way um and then uh um the students you know what should we improve again you know that more awareness of mental health and support really good ideas from students about having support groups at school you know for students to attend you know on on a drop in basis and when they're feeling that they need that support um diversity and Equity to ensure that everyone feels welcome no matter your ethnic background or sexual orientation some really um good and um thoughtful responses from from students and parents so brings me to my uh second to the last slide overall consideration so if I have to think of all of the data that I poured through and looked at and um and and really thought about you know

070I come down to some of these considerations um that um summarize what what families and students are and staff are um thinking about um and continuing to explore different ways that we could provide intervention for students um the integration of Technology the apps and the learning tools and then of course comes with that all of the training um seal programs you know that was one that was talked about a lot by all three stakeholder groups um and then expansion of summer program offerings and then in terms of safety again uh uh social emotional learning was mentioned a lot in um in the survey and the forums um look into anti-bullying programs so you know that that might be something that we could um I know that we do that in a lot of the different

071work that we do you know with um with um social emotional learning and with um uh what do you call the the school climate and culture programs but maybe looking a little more into um targeting that area as a as a goal uh school connectedness is building capacity for parents again in in the area of social student mental health and wellness um maintaining Zoom for Access for parent meetings um and then intentional professional development again in um technology and platforms for parents so the next steps in this process are um to present uh a draft to the Board of Trustees um and with the advisory groups in June we'll have a public hearing um to hear comments from the public on the plan and then in late June is when we will um send the

072um bring the elcap to the Board of Trustees for for adoption um the lcap needs to be approved by July 1st thank you so much Miss Garcia a very very important information um so great to get it summarized um I know there is so much more that you all heard but thank you for uh providing uh that overview for us here tonight so at this time I'd like to open it up for public comments and then we'll go to trusty questions comments um Mr Moran do we have anybody on from our public who would like to address the board at this time board president at this time we have no one uh actually we have one now Adrian vain all right welcome Adrien as soon as you begin speaking the timer will begin hello um

073my name is Adrien Vain and I am a teacher at George middle school and I would like to say I'm glad that we reached an agreement regarding online learning um I'm not happy with the way that it was done I think it was done very last minute and that was very upsetting and Adrian I'm sorry to to cut you off I just want to confirm are you here to speak on the LC cap or on something I will get to that one of the things with the elap is that we did like everybody saying they loved the morning meeting that's something that if we want to continue that that has to be um uh negotiated with our contract and right now we don't have a contract so that's something to please keep in mind is

074that if we want to plan accordingly we need to start planning now not last minute thank you thank you aan do we have anybody else Mr monan from the public wishing to address a more uh yes we have Brenda sendas welcome Miss sendas as soon as you begin speaking the timer will begin is this for public comment I just want to make sure I'm speaking on the right one yes this is public comment for the lcap the presentation that we all just saw Miss Garcia present on yeah I just want to thank her for all her work I think that um hearing the Imp of not only staff and students but getting a more clarity on what our school needs and what we have been doing and improving as a parent it makes me feel

075more at ease that these studies are being done and that as a staff and team we are working together to create Solutions and I just wanted to thank Sandra and the whole team for doing this I truly appreciate that thank you thank you Mr Manan we have Sean SS welcome Sean as soon as you begin speaking the timer will begin Mr swis if you could please unmute yourself sound like one of my kids um I'm I'm really pleased with the comments or the information that Mrs Garcia uh presented to the school about how well on the L Capal how well the parents and the students value US teachers it's really good to see how important we are in this District to their learning um I would I appreciate everything that she pointed out I think

076those are great ideas and I hope we can find the budget and the for that and incorporate those things into our school learning when we're back in school thank you thank you Mr monan do we have anybody else at this time we have no further comment great thank you so much does did somebody want to say something I'm sorry did I hear somebody no okay so at this time I'm gonna go ahead and open it up to the trustees um for any questions or comments I do see trusty Chavez raising your hand uh I just want to ask a quick question for now who was the last speaker please what was his name Shan last last speaker was Shan swis thank you any comments or questions for Miss Sandra uh for Miss Garcia okay I

077do see Mr fam andano and's so we'll goad and go in that order trusty fam uh oh unmute okay am I unmuted yes I am uh first of all thank you Sandra for your presentation I I think that you know this is a great service that you've done for the entire District uh let me just say that you know in light of the previous Co you know comments uh this is kind of like a progress report for our district you know it it tells us you know uh what we're doing right and you know the things that we ought to improve upon so I I certainly think you know and I look forward to uh the May presentation when we have a better picture and you know as well as the adoption in late June

078after the the town hall for the lcap because uh at the end of the day we serve students and their families and if we're you and it is incumbent upon us to address their needs uh you albe it within a manner that that fits within the resources we have at our disposal so uh I you know I again thank you for for contributing to uh uh a better understanding of what we've done right so far and the challenges that we will need to work on in the days and months ahead so thank you so much Sandra thank you trusty H famam uh let's go with trusty Beano thank you and as always thank you Miss Garcia for your report um I think one of the things that I appreciate that you do and have done

079this month is you know give us a little more context about some of the the responses that we see and and I appreciate this month the the what you shared with regards to this um our students and and bullying and and that whole idea it's something that we've been talking about for a long time now um and I I want to also encourage us this concept or this reality of of bullying cyber bullying is is you know obviously very complex and there's a lot of research on the topic and we also research about um the assets the developmental assets that our children have in in our community um and so the part that I want to maybe encourage us to to look into and and further develop in our programming in kind of conjunction with

080the um anti-bullying and kind of creating those safe environments and and that piece of it is the other part of it which is the building resilience in in Youth and I know that's a huge very broad area and topic but I think specific to the the idea of bullying and cyber bullying um I have a good article that I found um that I'll forward to to the team after um the meeting but I think one of the things that is being recognized is that we want to teach anti-bullying and create those environments but we also know that in the world a reality is is that there will be um situations where children youth adults will be put into situations that are difficult and and you know if we haven't done our job to prepare them

081to deal with those in addition to trying to do anti-bullying then you know we may not have done our job in in in helping them to be resilient to those situations so I'm looking forward to us as we try to bolster our anti-bullying efforts to also um maybe get a little more uh a little deeper into some of the resilience building and and match those two together so that we have an environment where bullying is not um accepted but we also acknowledge that things like that will occur and we will build students who have the the assets and the abilities to handle those situations so um so that's kind of what I had to say about that but I think that I do agree that's a a big piece and ties into a lot of

082what we're trying to do in terms of getting students to a place where they can perform academically because some of these other factors have been addressed so thank you again miss Garcia thank you trustan board vice president kto uh I just want to thank you for the work uh that you did on this report you team so thank you very much for that I appreciate you making note of the area is or there's some deficiencies or where there's uh more to be uh investigated and so looking forward to that digging down deeper and finding out where those uh students are that don't necessarily have a a um a position on a given issue so thank you for that thank you um and I just have a couple of um questions and comments uh I think

083you know sometimes we highlight on the negative right like some of us like to highlight on the ne negative so I want to highlight you know especially that one slide where you um let us know how our parents are feeling how our students are feeling in regards to safety um so it continues to you know make me um proud of the staff that we have out there of the adults um that create these safe spaces and I'm not surprised you know that they feel safe or that most feel safe um and then obviously too right um as you also mentioned it's important to see those that didn't have either way you know and where they're at and then also whether it's one or 90 you know in this case I think I saw seven for

084example that didn't feel safe and so I'm wondering if in the survey and I and I'm sure I filled it out I just don't remember right now but if there was a part where they could say why if they wanted to not not in this survey because we have to add those questions at the end but it's something that we could add as a question as a follow-up question we definitely could add that yeah and I think you know maybe it might be answered and maybe not but I think it would be good to provide that opportunity um and then trusty chavz I see your hand up in trusty witho I'll go back to you um as soon as I'm done here and then also in regards to the I I also remember the comment

085from the parent right and similar uh where she says about her daughter feeling anxious and anxiety and um some of the support services um and so I'm I'm wondering too if there's an opportunity um for the support to her to go beyond that survey at that time um so you know kind of similar to the question I was asking to provide that opportunity for the few parents you know maybe that um need additional support if there's a way you know to put a comment and so we as staff or the staff can follow up I'll definitely look into that sure thank you and then um one last thing I just to I think highlight what Mr um trusty was saying about the uh bullying right on campus and then all the additional I also heard

086the students say they want support groups um and I think it could be combined right um the support groups to deal with a lot of these things that uh our children face dayto day and um I also heard the teacher right speak and I you know I I do think we put a lot on our teachers and so um Dr Bower you know just an opportunity for in the future to look at um you know we have several partners that you know already do this work so we don't have to add it to our teacher um who are already doing so much for our children and so I look forward to discussing um more opportunities um and ensuring that our children have access to support groups thank you and we'll go ahead to go to

087trusty Chavez and then trusty uh Sandra once again you did excellent work and I appreciate everything you do and I did want to ask that kind of um saying something close to what uh Bina just finished saying that to to get both the pros and the cons because I think it's very important to listen to both sides and the why why do they feel that you know they had a negative experience and more importantly do the followup on all of the on the noes and you know the one on that don't feel comfortable we could learn a lot from from the reasons why they aren't and maybe improve on that thank you yeah I actually wanted to just um Echo quickly the comments of Trustee of President erera um in terms of of the overwhelmingly

088um positive numbers that we see from from our overall Community I think unfortunately sometimes it's human nature and anything that you know the negative gets more focused um and so you know we see in the media our district with negative things we see on social media people you know pointing out a lot of things and that's that's good we need to know that stuff too otherwise we'll never know what to improve on but it's good to know that the overwhelming empirical data demonstrates that that our um families are are very happy with our work work and and I mean that's clear to me but I'm just glad to see that narrative and I want to also raise that up because there's a lot out there that is constantly negative um and it's very often in

089my estimation a false narrative that is created about our district so so thank you again for pointing that out thank you trano and with that if I don't see any other hands up um we'll go ahead thank you uh Mrs Garcia for that uh presentation um and we'll go ahead and move on to um item 301 and this is uh for public comment um public members who wish to address the board on any item that's not on our agenda tonight um so go ahead and um please raise your hand if you're here for this item um and Mr Moran if you can uh before we open it to the first person if you can let me know um how many we have right now now total yes board president at this time we have three

090speakers okay okay so um if we can go ahead and start with with our first one the first speaker is Michael poing welcome Michael as soon as you begin speaking the timer will Mr poing please unmute yourself yes I I saw the uh good evening um I teach a Joseph George uh as Miss vain said earlier I too I'm happy uh that we uh have met uh and finally reached an agreement to go forward uh with the instruction of some students in uh in person I am concerned that we are in uh we inaccurately res presenting what uh we are doing with the students I I'm not sure that the parents truly know what the junior high students uh learning situation will be in that afternoon block and I would like that to be U

091made more clear to the parents I'd also like to as Miss B pointed out there are a number of things that are quite positive that we've learned through this distance learning like the morning meeting uh advisory as we call it in the Junior it's a time where I've gotten closer to a lot of students than I ever have before and that uh it is is a good resource that we should continue but again like Miss vain said if we're GNA carry something over like that into the future we need to we need to plan for it and to plan for it we need to work cooperatively with the board with superintendent hararia Dr Bower and uh and to get things planned in advance for once please let's do something without having it you know almost

092literally come to the midnight hour we were some of us even with medical uh you know seeking medical exemptions we didn't know we had medical exemptions until maybe 12 hours before we were expected to report to school and that's just not acceptable thank you thank you Mr monan yes next next speaker is Danielle de Ambrosio welcome Danielle as soon as you begin speaking the timer will begin hello my name Daniel we accidentally are got muted thank you okay um my name is Danielle I've been a teacher in Alam Rock for 20 years also um on the area bargaining team I would like the board to know that we could have reached an agreement much sooner if the compensation hadn't repeatedly come back to area as zero you would have had a lot more teachers volunteering

093to come back a lot sooner than you did as of about 6:30 p.m last night to be exact hopefully moving forward board members and Dr Bower when we negotiate for summer school reopening in the fall and our next three-year contract we can only hope that you have learned from this what not to do last minute agreements cause anxiety mistrust taking the joy out of important events um like for me example for today I was so excited to go back but I mean really not negotiating a contract until 6:30 p.m. the night before I'm going to be honest with with you it kind of took the wind out of my sales kind of a lot and actually all the other teachers on my campus that showed up there as well of course when the kids come

094and we see their faces of course we rise to the occasion of course we do but it did not have to go down like that the definition of a negotiation is a discussion aimed at reaching in agreement let's hope that moving forward we are not doing any more last minute contracts and and we don't even have a start date by the way we don't even know what day school is starting in the fall that's kind of alarming and let's just say we choose you know August 18th as a start date we better not be negotiating that contract any day near that because that would be ridiculous if we've learned anything from the last two negotiations of what not to do basically that was it thank you thank you Mr monan yes next person is blenda

095SAS welcome back blenda as soon as you begin speaking the timer will begin good evenings today I'm speaking as a parent I want to thank the Linda Vista teacher staff and George Middle School teachers for doing a wonderful job with my two kids I'm here today to stand in C it with all the teachers I'm really disappointed that the district played with our teachers emotions you played the parents it's very disrespectful the lack of information you gave me as a parent having to hear a whole bunch of parents calling me scared uncertain with no information Wednesday a lot of posts about uncertainty and all platforms when you say you don't want to see negativity communicate do a better job you had one year to plan this reopening I don't know what you did with the

096covid money I don't know what it's been used for I would like to know I would like that to be on the next agenda and what you're planning to do with this covid money that you're going to be getting this created a lot of anxiety on our teachers as I heard right now Panic anxiety depression frustration you name it don't use our kids my kids to get to them that's almost like being in an abusive relationship our teachers love those kids and you guys know that and our kids love their teachers I heard today Ernesto highlighting bully well it starts with you when you post negative comments about parents and don't say they're candidates because when I speak this is about me right now I speak as a parent and you shared profanity on social

097media and negative post and you sit here and dare to talk about bullying you need to work on that yourself you are the biggest bully in this board thank you thank you missas Mr Moran yes we have Adrien vain welcome back Adrien as soon as you begin speaking the timer will hello uh thank you once again um I I felt very disrespected with the way that things were done last minute and that's the way that this district has done things over and over again and I will tell you right now I'm I'm the union rep for George middle school I had many teachers contacting me over break when we're supposed to be relaxing and you know taking care of ourselves as Dr Bower wrote in her letter to us when we went on break we

098could not do that because of the anxiety of what is going to happen none of us knew what was going to happen and that was extremely disrespectful and I will tell you right now I had many teachers who are looking for new jobs if you continue to disrespect us you are going to have a teacher shortage and I love where I work I love working here I was teacher of the year for the entire District but this has felt like a slap in the face we don't have teachers love to plan I love to make sure that everything is perfect for my students and I didn't feel like I was able to do that and I'm still not able to do that for next next year because we don't know when we're going to start

099we need to stop being last minute fighting against each other we need to start working together you can't keep on treating us like this or it's really going to you're you're going to lose people you're going to lose people parents and teachers please let's work together thank you thank you Mr Moran next speaker is yolinda mendosa welcome Miss mendosa as soon as you begin speaking the timer will begin hi thank you H good evening superintendent Dr B and trustees first I'd like to thank you for selling her with our Union second I would like to let you know that this could have it much better process if it have been negotiated long and both just like all the speakers have said before me process was so cha and it mentally did hurt as a teacher

100how could we have relaxed I know that you all got an email from me and I only got two responses thank you trusty Chavis um I really did like the personaliz Mage me um second third how can we support our students when the very people that are supposed to support us are bullying us and causing that Society I thought you were not supposed to this organized very chaotic now we do have an agreement but we have other problems since our school is trying to pack our classroom or essentially being forced into the class year as you didn't know our school has a weight list of students who did not be allowed to survey but since there spot now there's more students coming in which will for us back into the class but we don't feel

101comfortable I feel buy because I'm being forced back into the class if I go back my students who really do need support in plog of instruction for reading and math they will lose that privilege because I have to going into my classroom and me four or five students there be R extra math extra read That's thank you Miss Mendoza uh gas we have anybody else yes we have we have six more at this time next speaker is Miss LOE welcome Miss lo as soon as you begin speaking The Tam will hi uh my name is Kathy ly I'm a she I teach at Shephard Middle School um I've been a teacher for 14 years and my mom was a teacher before me at George fiser and also Shephard the actions that the district took um

102this during spring break and for negotiations caused a huge amount of anxiety in me I'm a PR primary caregiver for my mom and she's really high risk and she hasn't gotten vaccinated yet um I've been doing everything I possibly can every day during this pandemic to make sure that I keep my mom my family safe and healthy and being forced back onto campus is more of a risk than I've been taking this entire time I mostly just stay home and I don't go anywhere so that I don't bring Co to my mom and kill her I already lost my dad when I was 21 and I don't want to lose my mom when I'm 42 so I applied for a waiver and I didn't hear back and for those days and days that I didn't

103hear back my anxiety got worse and worse um I've been in pain like physical pain now from the anxiety even though it's all done the the pain is still there now so like I'm GNA have to figure out how to mitigate that as best as I can I didn't hear back until Friday no sorry I didn't hear back until yesterday at 4:30 um up until then I was thinking I might have to take all of my sick days because I'm not putting my mom at risk I love my students I love my students more than almost anything but I can't put my family at risk for poor planning this is poorly done you could do better thank you thank you next person Mr monan next speaker is Sandra Rivera welcome Mr Riva as soon as

104you begin speaking the timer will begin okay hello yes we can hear you okay thank you sorry phone difficulties my name is Sandra Vera I am a fourth grade teacher at Chavez the union vice president and I have had the um pleasure of joining the bargaining team for on a temporary basis while we work through these next few few negotiation sessions um I am just on today to let you know the frustration and the difficulties that this last month has caused um during covid our district plan has allowed us to have different health benefits that have greatly improved um mental health for the teachers um for myself included I started using some of the programs that are offered through our program and I had gotten to a really good place um except for this last

105week this last week my health took a huge dive so much so that you know my doctor called me to write a note because my blood work came back bad so much so that um I was told to possibly advised looking into seeing if I could go out on disability just for for the sheer stress of everything that has happened I had numbers going off of the charts so I would hope and I am asking that in our next few negotiation sessions that we please go to the table with transparency with openness and with the ability to bargain please let your District negotiations team know what they are allowed and not allowed to do and to offer it created some very tense full and not needed um Stress and Anxiety for all of us thank

106you thank you next person Mr Moran next speaker is Shan SS welcome Sean as soon as you begin speaking the timer will begin all right thank you again for listening and hearing um I won't uh a lot has been said from the teachers I work at dorsa Elementary School third grade teacher um I just want to know a couple of things to the board members how many of you own your own business or work for a company because I want to know how you would have felt if you waited all week until April 9th and heard news from whoever I guess Carlos Moran posted uh news to us at 8:44 p.m on April 9th now I I think if you own a company that's pretty bad honestly most companies would be be looked at really

107negative about posting things what they want the teachers to do so I thought we have almost a all new board members and we have we've supported you guys through a lot of things in this district and I thought for once that you guys would be on the same page maybe you don't you didn't know so I could only count that maybe you didn't know what was going on maybe you were in the clouds nobody told you it filled you in maybe you didn't see the timeline that they did all right so that's a wasn't very good second thing Dr Bower you posted a letter saying that the all the board me Members unanimously voted to have us come back to school that wasn't true was it it was a 3 to2 wasn't anonymously so let's

108get our numbers right um and last but not or two more things nesto I don't know I can't say your last name so I don't want to mess it up let's have positive impact in social media let's get rid of the negative impact that you create the board members and the people in the district office create with us teachers and last but not least this is what Mr Garcia said uh how wonderful uh the parents think of us and treat us and the kids enjoy us so remember we are a very vital part of this district and if it wasn't for us some of you wouldn't shine in the district office thank you Mr s uh Mr monan yes next speaker is Michael poing welcome Mr polling as soon as you begin speaking the timer

109will begin uh yes um I'll return to some of the same points that have been made but I think uh it is uh good that they're emphasized uh the anxiety and stress that was caused completely unnecessarily by I don't know what by poor planning by a lack of communication between the district and the negotiating team between the student uh the Board of Supervisors um I'm dealing with cancer and I was you know I mean I had a I had a bone scan I was in an MRI on Wednesday and not sure if I was going to get an exemption until you know again 12 14 hours before I was supposed to report to school you guys have got to do better you've got to do better for your teachers as Miss uh vain was pointing

110out and some of the other uh people have said you're at risk of losing good teachers people that have got a number of years 10 years 20 years they're going to say okay I'm bailing on this I'm getting out of here early it's like I'll find something else or I'll just retire early you have got good young teachers who are like are you stick around here is this the way you treat teachers this is this is the way this is is going to operate you've got people not brand new teachers people that are three four years that are you know just about to be vested uh in the uh retirement program and they're going to they're going to bolt on you and you're going to lose these good people people I've got 25 years of

111teaching experience and you're you're pushing us out the door and sometimes it makes us think that's the plan let's let's make it really difficult let's drive the uh more experienced teachers out the door because they cost us too much money and again and I too would also like one of the parents asked what's G where is the covid money going we want to see that well documented please thank you good night thank you Mr Moran yes next speaker Jessica levati welcome Jessica as soon as you begin speaking the timer will begin hi yes my name is Jessica leody I'm the area rep for Linda Vista as well I want to First applaud our area members and our bargaining team who have done nothing but tirelessly protect us support us and and second I want to

112say that um this week has been a nightmare these past two weeks have been a nightmare and I even talked to my therapist this morning and she's like are you in an abusive relationship and I was like I think I am with my job and um I applaud Brenda who I think we just need to frame what she said and remember it and recite it every day um a lot of great things have come out of this year with distance learning and we are just throwing it all aside for the last six weeks of school and my mental health has deteriorated this past week and it is it's just so sad because you keep telling us how great we are how we need to focus on Mental Health how we need to support our teachers

113how we need to not put more on our plates and then we were just given a buffet last night and and we need to figure out how to serve it all by morning and it makes us look bad it makes our principles who are working tiously to help us as well uh look bad because we couldn't reach an agreement and that is disheartening and I cannot tell you how many teachers are wanting to leave right now um who are having mental breakdowns who are not okay and we support you as a board we support our supervisors and our in the district office and you need to support us um and where is that money going because if it's not going to the classrooms where is this covid money going thank you thank you anybody else

114Mr Mor yes we have uh this time we have two more we have Veronica welcome Veronica as soon as you begin speaking the timer will begin great thank you and I was not going to speak but just hearing all the teachers makes me very sad makes me sad for them because I can't do anything and also makes me sad for my children because I know my children's teachers have been amazing and I can only imagine how amazing this teacher speaking are um and just hearing the thought how there two the last two weeks have been for them and for the staff I'm sorry as a parent I wish you know you could stay because I know you offer the the best for our students you are here and you're not here for the pay right

115because we're in the E you're here for our students and I appreciate that and I appreciate your consistency and I appreciate you always standing up for our students and advocating for them and being just an amazing teacher that you are I really want to thank you for all your work that you do um I know that for both of my children you know my teachers and every single staff has gone above and beyond for them and they treat them just like one of them and I know that when they eventually go to middle school I know this teachers will also be there um and it seems like they might be leaving and I'm sad about that I'm sad because again they're not here for the Mone they're here but we still deserve to give them

116respect not just to the teachers but the whole staff um you know I as a parent I stand here with you and I can only offer my how grateful I am for you to be one of my students teacher and you know many of our students um and so anything that you need know that the parents we're here for you thank you thank you next person Mr Moran next person is s l welcome Sy as soon as you begin speaking the timer will begin hello hi I'm calling in tonight um I just wanted to make some comments about you know coming from the from the point that I'm a kind of desensitized to all of this anxiety because I am an essential worker and a parent here that has had to go back to work

117and I am a highrisk my family is high risk but I'm almost like my bubble was forced to be popped early in this pandemic because I've been back out there so I I definitely appreciate and and and and I'm so amazed by all of our teachers all throughout not just our district but really in this whole country of what's had to happen with all of this and I just want to bring to light that what this pandemic really has done is unfortunately in the in the beginning it brought us all together it seemed like things were going to change and then all of a sudden there's so much division between people and and human kindness and what we are and who we I feel generally all want to be and I hear in these meetings

118people talking a lot about all this bullying and things of this nature with regard to things that that a a a candidate said at some point that I saw myself I've been at every one of these meetings and heard that and that wouldn't have had my vote and all of those things have nothing to do with what the core the foundation is and that is our our teachers but the very bottom of the core of all of this is our students and that I don't hear coming out in a positive light I I I just I really want to speak tonight to say that I hope we move forward this is very hard this has been a challenge like no other and our students and our teachers of all times this has never happened we've

119had a pandemic but no one has done what that those two groups of people I'm a health care provider and they call us Heroes our students are the ones who have come through this been through it and to it and not without everything that the teachers have done so Community let's stop going back and forth with each other and calling out names of people and talking about bullying we are adults we are humans let's get that kindness going let's move forward none of that is getting us anywhere we're thank you so much Miss L um and with that we'll um go ahead and move on to our next item 401 alen Rock administrators Association do we have a representative here marel Mr Moran Dr Bower you can help us look through uh Maria martinz I

120think she's in okay we can bring her in I'm not seeing Maria Martinez okay maybe we can move on to the next one and then we can come back to her if she comes back on unless there's somebody else here for a if we don't see her we'll move on and then we'll check in with her and see if she'll come on um let's move on to Teamsters um and we we can come back to 401 teamers is not gonna be here tonight although he wanted me to share with um the teachers that they are in solidarity they're very happy that we were able to reach an agreement and I wanted to say that publicly because that's what Mr Tom Fu their representative said to me this morning thank you great thank you so much

121um and then if we see Miss Martinez um please let me know otherwise I'll go to um 404 up to 404 and then we'll come back to her and I Madam presid I think it's 403 403 but we'll go what what I'm saying is we'll go all the way to 404 oh oh okay and if she comes on we'll go to her after uh 404 okay thank you trusty fam so we'll go on next to 403 California School Employees Association we have Sharon here she is here welcome Sharon you're welcome to unmute yourself thank you thank you can you hear me yes okay good evening Dr Bower board president board members um I've heard a lot of comments from the teachers today regarding the reopening and it's been a trying time I know for them

122but also it has been for our members especially our par professionals um they've been getting a lot of direction from many different people from teachers principals um directors and um it's been a trying day I must have had probably 50 phone calls and emails from Paris because they don't know what to do and that being said I am happy that they are reopening for iners and we just need to have a meeting which I do have scheduled and thank you Mr Moran for agreeing to meet with us tomorrow to see if we can get everybody on the same page where our pars are involved as you know all of our our 90% of our CCA staff has been back to work since July and August of last year our office staff and our district office

123staff they've been working holding down the fort doing well at the school sites and um I'm sure that given the next few days we'll be able to muscle through this and come out on a positive note in the end and I will be speaking one more time on a close session item so I will close now and I will come back in a little while thank you thank you Sharon um and now we'll move on to alumrock Educators Association area do we have Joselyn here or somebody who will be speaking on behalf of ARA today thank you you can raise your hand i'm can you hear me yes welcome Joseline thank you uh I I want to preface what I'm about to say by saying that the area teachers that spoke this evening or the

124parents that you've heard from we did not get together and plan what we were going to say but you will be hearing many of the same ideas throughout what I would like to share with you so as you know area in the district managed to reach an agreement for in-person instruction late yesterday afternoon I want to thank each of you for whatever hand you may have had in reaching that agreement we are relieved to have averted any additional stress on our teachers by having them report in person to their site to deliver distance learning in an empty classroom Not only would that have served no purpose it would have increased the number of people on campus therefore increasing the safety risk for all what should be positive signs that we may be seeing a ray

125of sunshine at the end of this pandemic by the reopening of in-person instruction has truly been overshadowed by mixed messages poor direct communication to the staff and community along with no specific plan in place until the very last minute bargaining the terms and conditions for a rate for a return should have happened prior to offering an arbitrary idea to the parents I understand the difficulty involved in satisfying the needs and interests of the students and parents particularly because of the desire to retain students and not lose any to Charters but to do so at the expense of the teachers who provide the boots on the ground instruction or by compromising the program offered to the students is not an effective approach when the district originally sent out a commitment form to teachers to opt in

126for in-person instruction it was no surprise only when 91 teachers opted in actually it was a surprise to me that so many chose to commit before they knew what what they were committing to once an agreement was reached late yesterday another request for volunteers was sent out to the teachers the number of volunteers Rose from 91 to 171 by this morning almost double it's amazing how far a clear plan and an offer of compensation for the additional planning and preparation can go while area members and I are so very grateful a compromise was struck it certainly wasn't without creating a lot of distress and angst amongst our members I know many of them have reached out to you directly for help and support so I'm not going to recap the severity of the pain and

127anxiety that they felt some of their stories brought me to tears this whole situation created one of the deepest widest holes that our membership has been in for many many years we have been demoralized and disheartened obviously this has been in addition to living through a global pandemic not to mention the threat of possible school closures also on top of all of this however the one constant Solace is that we have had each other we have had the support of our Union brothers and sisters to lean on throughout this process I'm sharing this with you because we are going to need a lot of help to get out of this hole and probably some passing of time it's going to take both help and time to develop any sense of trust again our members were

128blatantly misled when they believed they would not be forced to return to in-person instruction as a result it has shattered the will of some to continue teaching in alumrock and of others to question if they even want to teach anymore at all we will get through this year but there is a lot of reparation necessary to bring back our Spirits personally I am very tired and I know I'm not alone the area bargaining team worked all last summer without compensation I will add to create us for summer programs extended year programs the distance learning mou that distance learning mou was not signed until August 10th of 2020 a day or two before our teachers had to return to work recently we spent every day of our spring break creating proposals for the reopening inperson instruction

129mou this was in no way a break for anyone it was not only not relaxing it was exhausting both physically and emotionally for all area members and once again without pay I have learned that working year round with no break and often times unpaid is not healthy to anyone with that in mind I am asking for your help please encourage the district to plan ahead and not wait until the last minute or even sometimes after the fact we need agreements in place now for summer school our collective bargaining agreement expires in June and other and any other plans or changes that require bargaining and reparation need to be done now as you've heard before today is April 15th and we still do not have a school calendar in place for the 2122 school year that

130is not uh because ARA hasn't tried we offered a proposed calendar to the district back in January there is absolutely no reason that this is not in place yet with the hope of Life reopening to some extent in June I plan to make up for last summer our bargaining team is done for the year on June 8th the last day of s of school this year and I am giving advanced notice that we will not be available to volunteer our time after that so please let's get done now what needs to be done I hope that we can do that together if possible thank you thank you Joselyn um and at this time I would like to go back to Miss Martinez if she's here Dr bow did she respond or and I was trying

131to see if there's another AA member so I can have my comments and then if somebody is here we can go do see a hand so I'm wondering if um Mr monan can you help us uh find out if that's an AA member and maybe they're here to speak no I'm I'm checking to see with them she won't be able to join us okay I just wanted um is Jonathan natividad from ARA and the representative to here to speak today uh I see is Henry's board president and Dr Bower is he AA I just want to confirm okay um so I will take it as um he is our representative here today is uh that correct uh Mr principal at hubber hi my name is j Mr uh Mr nativ are you here um as

132a representative of ARA yes I am hello can you hear me yes okay okay welcome hi hi my name is Jonathan natividad uh PR principal at hubard media arts academy speaking on behalf of ARA today was our reopening with third through fifth grade students and I want to give a shout out to all teachers especially my Herber staff uh everyone came with their game faces on they came with love in their hearts welcoming students and families uh just want to share creation we had all these wonderful things happening I know at adalante they shared the red carpet roll out for students at hubard we had our step and repeat banner and again across all of our uh third fifth grade schools we just had a lot of excited families I want to give a shout

133out to parents who went above and beyond filling out the health screener forms and shout outs to all our custodial office staffs and everyone in our district who made this happen for our families we are excited to uh begin next week on Monday with reopening for all of our TK through eighth grade students and like I said um if you get a chance to come by and see it you're going to see a lot of happy smiling faces a little bit of apprehension though but again uh as time goes forward and we start building these relationships with all of our stud students and families uh we just can't wait to serve our community thank you thank you Mr nativ um now we'll go ahead and go on to superintendent thank you Madame President I just

134want to um let everybody who spoke today know that um I do respect all of the comments and I took notes because I would like to move forward collaboratively to be able to um to repair some of the the mistakes that we made and I have no problem accepting however um I also in that manner I want to be able to um to say to you that it has always been our goal and Our intention to work collaboratively and to be able to come to agreements in a in a positive manner and I do appreciate tremendously the effort for from the area Neo negotiations team we have we were going back and forth until we had something that worked for kids I think that that's at the end of this what happened um and I

135am very proud of that and I'm proud of the work that we were able to do together it was very diff difficult we have never been a you know there there was no Playbook about bringing a a whole District back from a pandemic and I think that every district and every superintendent had a different situation and every board had a different situation so um all of us together were able to reach that agreement um uh I can remember somebody saying don't let the perfect get in the way of the good and I I thought a lot a lot through through the the endless nights because there were endless nights where we were going back and forth to be able to to know that uh although we strive for perfect sometime we are not able to

136achieve perfect and it's not for lack of trying and it's not for lack of um not wanting to get perfect and and I wish I could I wish I had AAG one with all the solutions and all the the necessary things and and uh but I just don't have it I have uh my commitment to you that um I want to make sure that we always provide enough support enough information I share with the teachers and all um the board members the timelines that we followed as we had those conversations um and I think both of our teams just you know it took us time and I know this is not the answer that you probably want from me but I do want to tell you from the bottom of my heart that I wanted

137to we wanted to work collaboratively with everybody and I think we did uh we reach an agreement and that's that's the evidence of that um I do hear the the the the stress the anxiety um I hope that we can move forward from that space to be able to build a new Alum Rock that knows how to work with each other in a collaborative manner um I'm willing to do that I answer as many emails and phone calls as I possibly could if I miss one please forgive me um I've spend my nights trying to find my emails if for some reason I miss somebody uh I will try again to be able to respond to what you are concerned about or your your your concerns your your uh the complaints that you have I

138have also some emails that were very reassuring and for that I want to give thanks to all the community members and the staff members who have been uh kind enough to send a thank you and to send uh let's keep on moving and today was a perfect example of that we were able to reopen in 24 sites um with um a a teacher in every of those third fourth and fifth grade classes we're still working following the agreement in trying to be able to provide what the other great levels that are coming back on Monday we're very committed uh to do that uh uh and we look forward to uh continue working collaboratively to reach a an agreement that works for the teachers and for the students and for the district as a whole I

139want to thank every teacher not only for those who thank uh thank God wanted to volunteer and came to uh uh inperson instruction I want to thank all of them because they have been heroes in so many ways and there are a lot a lot of them who um have done an amazing job all of our teachers have done an amazing job in the in the evidences in those survey results that Sandra and Anna presented to you so thank you uh I also want to thank our classified staff uh just like Sharon said 90% of the classified staff was working in person for the majority of the year and I want to thank them for that both teamsters and CSA doing an amazing job Community lons doing um home visits and Teamsters U maintaining our

140uh facilities and everybody so thank you very much for all of your hard work I am after 56 weeks of not having official in-person instruction I think that today was a historic moment for Alam Rock and I want to thank every single one of the 2,000 um area um alumrock members that made that possible and I want to thank every single parent that brought their child today to our doors for their trust because they know we provide great education thank you so much for your support move moving forward thank you thank you Dr Bower um and now we'll move on to the trustees um any Communications or comments I'll go ahead and call your name as I see you on my screen um assuming that you'd like to say something and if you wouldn't just

141let me know you wouldn't and we'll move on to the next person um so we'll start with trusty Chavez you move on to the next one I'm looking at my notes okay if you can be ready on the next one we'll go ahead and go to trusty f all right if I find my notes I can thanks hopefully before the end of this session sorry well two things uh you know the the ne you know I I do have some some others but that is related to item uh 6 point is it the the odd uh 6.02 so I will reserve it then first of all uh congratulations to Dr bow and staff uh you know we received news about the uh the $3 million Early Learning Grant from first five I know that the

142details of the grant aren't out yet but uh that Grant I think will allow us to augment our early learning programs in a very beneficial way uh second part yes today is a historic day uh 24 School sites we are reopen for the first time in over a year I do want to uh thank everyone and I I want to you know let it know let it be known that yes I get it that the the whole negotiation portion uh has been trying on us all uh that was on my mind for the last two over the last two weeks and I to I I to uh heard the concerns from teachers staff members parents I responded to many emails many of which were were touching in uh from personal situations a and also just

143general anxiety and I'm glad that yet even though this played like a foot ball game that ended up in double overtime we have a deal that allows us to to move forward not only not only to reopen but I am very also happy to say that uh Alam rock is the only District that is offering inperson instruction for four days in the eastern half of San Jose and that is certainly an achievement uh that needs to be recognized and commended for the fact that you know we are offering something that no one else is offering you know so I want to make it clear that Alam Rock has heard the concerns of our community and we have responded in a way that uh that you know matches the aspect operations in the needs of our

144community so I want to you know once again applaud uh for my colleagues and myself who who played Diplomat on more than one occasion throughout this whole negotiation period to our uh Administration to area members who the despite some contentious moments we were able to find common ground and get to an agreement so that we could move forward in such a huge in a way that you know that we are able to provide even more than our surrounding districts so uh on that note I you know just thank you all very much thank you trusty fam Jesse Chavis have you found your notes I I take it as a no um welome back to you uh let's move on to board vice president kto yeah I want to thank um oh I want to start

145off by thanking Jolan Smith um and arusd alumni who actually went to our schools and has been a huge Champion for Alam Rock and so just uh that early learning Grant in large part is due to significant amount of work put in by her and so here we have the um the dividends of an elmrock educated person who's now in a position to be able to bring back resources to their Elma moer and so thank you very much Jo for uh the excellent work and getting us the resources that's just the tip of the iceberg we've seen uh Family Resource Centers and tons of other stuff that if I sat here and to uh lay this all out we'd be here all night in terms of the resources that Jolene has been bringing to to

146her Elma M so thank you very much for that with regard to um the reopening I want to thank each and every person who been involved in the process teachers students staff uh for getting us to to the reopening um I I I I completely acknowledge that there were um uncertain there was uncertainty uncertainty that was caused and I do appreciate I want to thank uh our top administrator Dr Bower for acknowledging the um the errors and the mistakes and so that's very important it needs to be we also I'm sure are going to use this as an opportunity for Learning and how to how to uh uh move ahead so I do want I appreciate that but I also want to acknowledge that there was significant amount of uncertainty that was out of our

147control um things like being declared orange tier on March forth and stuff of that sort are are things that happened as a result of a good thing the rates of people being in hospitals um the the county um doing well and vaccinations and stuff of that sort all wound up putting us in a place where uh this where the state ultimately declared that it was safe to to reopen and so I want to make sure that we acknowledge that uh while um there were some some issues with with regard to the district U the ad Administration um we also uh were dealt with uncertainty that comes from uh the Declarations that are coming from our our our our government our authorities So based on that I just want to also acknowledge that there was uncertainty

148there um every one of you that came and spoke I want to I want to express my true uh appreciation over the fact that you're here you're here to uh make sure that uh we're aware about your concerns and that's the magic and the beauty of a public school district like Alam rock where we have these venues that provide a forum an opportunity for folks to come and speak uh to the district this is your district and you're here to speak to it whether you're employee or taxpayer in the district uh resident you know regardless uh appreciate each and every one of you for coming in and sharing your perspective um I I I ALS for example I want to thank each and every one of you who brought up concerns about covid you have

149a legal right to know exactly where your resources are being spent um these are public dollars and so I that's therefore for that reason I'm asking Administration to bring back at the next meeting a thorough presentation on the expenditure of covid monies which um is a legal right for anybody to to ask for and I I very much am looking forward to seeing it uh so that your concerns can be a sage you can in detailed fashion know exactly where each and every dollar was spent um and I'm sure that staff's going to appreciate that opportunity to to make sure to uh to provide the proper dislosure that way there's no no no um um uh concerns that are left unanswered so um thank you for for that in advance the administration um I I've

150heard your concerns a lot un clear with regard to not receiving communication uh from some board members I'll speak for myself I I am of the uh mind that negotiations are done in not in not in public and so if you don't hear from me it's not that I don't want to talk to you I will go wherever it is that people want to talk to me many of you have called me for meetings I've been there our Charter friends have asked me to go and attend their meetings and every time they've asked I've been there um and so I'm I want to speak to folks and hear your concerns that's the way I inform myself however when negotiations are taking place I myself as a union member uh adhere to the generally accepted principles

151of not negotiating in public and so therefore I tend to um leave the negotiations to the to to to be dealt with by the officially uh the official representatives of the bargain unit so if you don't hear from me it's not that I don't want to talk to you it has to do more with respecting the place of our Union to be the official voice of of our our bargain units and so I just want to make sure to clarify and let folks know where I was coming from that way you don't think he just doesn't want to acknowledge my concerns are uh with not uh stepping on or not respecting the place of the bargain unit to be the official uh negotiators for for the bargain unit so just want to make sure that

152folks were clear that way if you didn't hear from me if you want to talk to me about other issues Beyond negotiations um I am all ears and I'm ready to to listen and to engage and so please please feel free to reach out when it comes to negotiations I feel that it's a realm and um the place of only the the bargaining teams to deal with with that specific area so um pardon the pun um I I I wanted to acknowledge those folks who are uh we we know that uh this is a new era and um Beyond acknowledging uh teachers students and staff I also want to acknowledge parents who have given us uh whove placed their confidence in alrock and and have hung in there with us um As the adage says

153for those Airlines you know we know you have options thank you for flying with us thank you for flying with us thank you for choosing Alan Rock and sticking with us um and so I I am intending to do right by our teachers I'm intending to do right by our students and that is what that is what um the the that's that was the impetus for my decision- making to make sure that we were taking we were finding common ground and golden means to be able to achieve um as much as we could for everyone and so that was the basis of my decision making I wanted to go ahead and speak to that and U we have we had eight 00 people who said we want to go back to in person I want

154to acknowledge that also want to acknowledge the concerns that are rais and so therefore I appreciate the um the the agreement that was uh able to be developed between our teachers and um our our district and so thank you for that for finding this common ground that allows us to be able to welcome back those students that want an in-person instruction and as well as a odate uh folks that for whatever reason for health concerns or whatever uh uh reason that um that is uh that has been agreed upon uh um you know keeps them in a safe in a safe place and so um I know it's a it was a tough time um and uh you know as my colleague board member fam mentioned it did take a lot of uh a lot

155of our attention and uh and so we we were very much appreciative of the of the work that everybody put into to find this common ground that allows us to be able to provide an inperson destruction to those children who've chosen to and to those parents who have chosen to send their kids back into the classroom um thank each and every one of you for the work that you do my comments thank you board vice president kto trusty Chavez are you not going to make a comment you are you're not ready yet you're not ready yet yes you're ready no okay um trusty veano and then trusty Chavez um you're gonna be after Mr veano so I hope that you're ready by then you find your notes trusty Viano okay thank you um you know

156trusty Kino vice president kto stole stole some of my thunder a lot of my thunder everything he said was was really well articulated and and I mean for the most part those are my sentiments as well I I will just pull out a couple of highlights that I still want to acknowledge I also um have here I wanted to acknowledge Jolene Smith and that work um to assist us in getting the grant that we heard about today um that's you know I think Early Learning is one of the areas that our district is separating ourselves and has continued to do good work um you know as as we provide the best possible services to our community and so that's evidence of that continued work and it's also support for us to continue to move forward

157so so I appreciate uh Miss Smith's efforts and and our District's continued efforts to move forward in in those areas um the second thing that I wanted to also acknowledge is that um you know the we obviously as board members receive over this course of time many emails and voicemails and Facebook messages and text messages and and all of those things that we heard every single thing that that everyone had to say and as trustee mentioned you know it's it's there's a process that is followed in negotiations and you know I myself wanted to allow those processes to to already challenging and already difficult processes to continue without my voice potentially getting in and and muddling muddying the waters even more I wanted to allow those teams to do that work without um getting involved

158in it that being said it's certainly the comments that we've heard and tonight other nights and in all the other ways that we've received them have have weighed upon me and and all of us as individual board members I know um you know in addition to our own work as as you know some of us essential workers or or you know our own jobs and families and everything it's also an additional burden on us when we're hearing this stuff and it weighs on us too and that's what we sign up for when we were here uh when we decided to come here and so the um you know I think that I want to acknow so I want to acknowledge everyone on our alen Rock team for this difficult process that we've come to at

159least some middle ground for now but I particularly want to acknowledge our Alam Rock negotiating team um Dr Bower and her team I know that the board provided um very clear and specific Direction over the course of this of of based on all of the factors that we had including feedback from parents and teachers and budgetary realities and all those things they were able to take that um information and go to the negotiating table with those directions from the board so I want to thank them for hold you know doing that work while at the same time it's kind of like they were doing a double job because they were out at schools you know getting stuff ready for the time that when we would reach an agreement so I know that they were out

160late nights and weekends and all week long you know getting things set up and so it was really a gargantuan um Monumental effort by by our alen Rock um negotiating team so I want to so I really want to thank them and and recognize them in addition to as I mentioned everyone you know as as negotiations happen there's um you know there's always two sides to negotiations and and you know unfortunately as I mentioned and trusty kto mentioned we can't always share publicly some of the information because it's part of the negotiating process but um I look forward to the board to staff bringing the um the report that trust Kinto requested next week because I think that more and more as information is able to get out there people will see um some of

161the details and and realities of what the situation has been so so I look forward to that report and continued um providing of information that paints the entire picture of the process um and finally you know I I rarely post things on social media and when I do it's you know it's backed by um audio or visual you know evidence and for that reason I was glad today to post a picture of you know our classroom with students in the classroom um you know as everyone has mentioned to this point it's really if we just extract ourselves from this moment and think about everything that every parent student teacher everyone has gone through over the past year even this boardroom where we're in and everything the fact that today we have students sitting in classrooms

162and parents who want their children in classrooms having to the extent Possible having that that wish um met is really speaks again to the efforts of everyone so I do want to thank everyone I think I you know I was at least one of the people who said we shouldn't let the perfect get in the way of The Good The District myself you know all sides I think have areas that we could um do do could have done better could do better in the future and I think if we continue to work through those things and identify them and and and work to improve them as we go I think we'll be fine I think what we'll get stuck is if we if we're stuck in finger pointing either way and we don't really uh

163we don't we're not solution focused so as long as we remain solution focused in any of our processes we will continue to move forward and see those um positive numbers reflect Ed that we saw from Miss Garcia's presentation tonight so that is my comments and hopefully trusty Chavez has found her notes and that's it for me thank you actually trusty Chavez you're in luck I'm in luck are you ready go why am I in luck because you're here with us go for it uh or wow I really feel lucky anyways um when somebody says what you have to say and then you have to edit it and then the other one add something to it so I had to do all these re-editing for my notes it's not that they were lost so anyways um

164I heard a lot of communication on how uh things were done things weren't done um keep in mind a lot of the good things that are done I think are done well that people forget about it but um the reason that people say what isn't being done good is because they want a better education for their kids and I always look at it like bring it on how can we make this better so I'm going to um make some comments that are actually gonna go towards making the district better not so much uh the other way so one of the major things is how do we serve the people and address their needs that they need to be feeled like they're respected and valued and I kept hearing over and over and I took everybody's

165names down that that wasn't uh the ma the way the majority felt there's another thing that the district I wanted to ask if they have a hazard written communication plan because I haven't seen one and it needs to be uh I think put out in writing so that everybody knows the plan and a lot of the times this is uh has to do with communication yes the communication was not good it can be improved on but I am going to ask instead of getting seven or eight emails we don't got nothing yet we don't have a contract yet I think time would be better served if you hold back on those emails or Texas or both and just do one concise clear message to all instead of having to constantly check on on those emails

166because or text and also Dr bow talked about a Playbook that nothing is been written but I think that something should be start getting written now uh because I think it would serve us better in the long run especially since there's going to be nego negotiations around the corner and yes we do need to do better um and we do need to have everybody's involvement and not last minute because I kept hearing this over and over it was a recurring thing that everybody was saying and um and as well as the trusty handbook I kept asking for one in the beginning when I first got on as a trustee in 2018 and we voted on it and I have yet to see handbook in writing there needs to be clear Communications because Sandra Riva said

167that she didn't know what she could communicate and what she couldn't if it's in writing people know if you want it to be clear it needs to be in writing um and I do thank you for and all the staff for all the good work they do but could we uh do better yes and one of the things is is everybody's not everybody excuse me I don't want to say it in absolute I want to say that there's a lot lot of people who question how the money is spent and I've heard it throughout board meetings what have you done with the money what are you doing and this last time in uh March 11th meeting I tried to get a board meeting in January I asked for a a but a budget meeting and

168I thought we were going to put one together another followup and we haven't and I know that the other trustee says that there's no urgency to but every single board meeting we hear about the money about the budget everything has to do with the money in the budget so I think if we could put something on calendar today that would be best the best thing if a trustee cannot make the meeting then maybe you know that trusty can make it the next time but I think that it's very important that way maybe we can address some of the issues of and how to put people at ease once the covid money because we don't have the covid money yet once the covid money comes in how it's going to be spent what they're supposed to

169be looking for because this other way there was too much on uity about how if we had all the proper PPE if it was in place and we shouldn't have to be uh addressing those things if they were all if it was all smooth it was all communicated than to focus are you talking to B directly no okay I'm looking at myself that's why I'm okay and um you want to make sure we're not evaluating her in public or anything like that uh can I finish now yes very important very important uh points thank you okay and and this is not an evaluation this is what the public was saying and I'm just uh doing that so I would appreciate it you not interrupt again and and I did want to know how many people

170did show up how many students how many in the hybrid and how many were in person uh today on the first day so we can draw some kind of number on that and also if we could um pressure or or ask I as I asked Dr Bower this if we can communicate to skoy and Dr danan if we could um start sending messages to the governor to expedite that covid money because since we haven't received it yet it is going to put a dent in our expenses and it's better that we have it sooner than later and um and if that information can be disseminated as soon as they uh they do receive it so that everybody knows hey we received it and thank you Jolene for the $3 million that's always helpful uh to

171receive that money for the education of the kids and um and here's something else that the reopening survey that it was flaw and I seen some communication on several websites um it was it wasn't uh laid out well and and I'm just saying that to better communicate with the parents and to put them more at ease and make things easier and smoother as far as communication goes please before you send out the survey send it to somebody else in the district to kind of check it because um sending the wrong information or not enough information or or a website is flawed that's not good that makes us look unal and we don't want to give that perception um it was uh something on the parents square that the parents were unable to complete the survey

172so I think that we need to do better than that we need to test the product before we put it out there to the stakeholders and that way there won't look like something was done um poorly and for now I'll keep my other comments uh for later thank you uh when you see when you say keep your other comments for later you mean other items on the agenda like Mr fam is saving later later so you're done with this portion I just want to make sure that we've given you later enough time that's it I'm done thank you okay thank you madam president yes uh board vice president Kimo um I just want to thank you for uh stepping in and reminding board members that there are things for example we've had board members in

173the past that have uh attempted to disclose close session information and so that is a role of the president to step in and keep keep uh keep us out of trouble because of the actions of a particular board member so just want to say thank you for stepping in you know keeping keeping the meeting in order also I forgot to make a quick comment um I wanted to thank uh you and supervisor Chavez and I forgot to include that on my comments uh for the excellent uh uh press conference uh acknowledging the opening of our school so uh as well as Dr danan and others have participated in the press conference earlier this uh this afternoon so forgot to to mention that in my comments thank you vice president GTO I see a couple hands

174and I kind of saw bow also raise her hand um bow is there something you also want to mention before we move forward no okay okay um I see trusty Chavez's hand um go ahead trusty Chavez um I just want to note that it wasn't necessary to interrupt and I'm very well aware of what's happened in the past and that was not uh the intention nor was it done right now thank you thank you trusty Chavez and at this time I'll make my comments um the job of a of a president during these times is not easy um and this is an example of it right now right um making sure we cross the teas and Dot the eyes um it's been a tough tough tough three weeks but more than that it's been a

175tough year and not just for me but our entire Community some of us have lost loved ones some of us have lost our jobs some of us are have lost our homes I mean we each have our own reality and I want to honor and acknowledge that at this time um I know that our community here in the east side has been the hardest hit you know um other than South County and so that's the reality that we're living and that's the reality of the time that either Creator ourself chose to lead um this district and um lead you know at a time where we've never done this before we've never gone back to school after a pandemic so I want to acknowledge everyone um that are listening in um we each have been impacted

176somehow or other uh being a part of negotiations um being directly on the negotiations team thank you um I've you know was an outer part of that and I know for me um I mean it felt like up to 10 hours a day um spending you know on that so I can only imagine the direct team that was meeting on on on both ends and as a union member myself um as I talked to um the uh area President and Vice President um Joselyn and Sandra I you know spent some time on the phone with them this weekend um I honor and respect them in their job uh because it is important to have a union um and I back up unions 100% And so I understand their job um and I also understand you

177know as a president here um ensuring that we get our babies back into the classrooms in a safe way and so understanding that we had parents who were you know looking forward um to having their children back in school this week um and you know having the possibility of of not you know having all of them and and um having teachers who had volunteered and and then maybe not and that back and forth um just really broke my heart you know thinking that um there might be children that might not be in a classroom for whatever that reason um was and um you know it's still kind of you know I have a little ache there because I know um that you know as we heard earlier that there might be students on a waiting

178list um for whatever the reason is and so I look forward let's just say I look forward to having 100% of our children back in school um with teachers that feel you know honored and respected as you should um and and know and trust that we're doing at least I can speak for myself and I can speak you know for for the direct actions that I see on our staff that we are doing everything um in our capacity to ensure that you are back in the classroom and um safe compensated um you know and not and not uh disrespected or anything like that so I heard you know some of those comments and I'm open for discussion right when again and I don't want to repeat what Board of Vice President ginetto mentioned um there's

179a reason why I didn't respond in the in the uh negotiations um honoring all the all of you who uh met um countless hours um and therefore I took it upon myself to talk directly to Sandra and Joselyn this weekend because I know they're on the negotiating team um and it broke my heart you know it was like hands tied because I want to respond with so many details and it's like it's a part it's a part of this process and um having the faith that um it would all come out to what today was you know opening classrooms seeing those beautiful faces um hearing Happy Teachers um honored to be there you know and um and and parents who are happy to drop them off and feeling safe um so happy about that you

180know again applauding our negotiation teams on both ends um happy that we were able to come to an agreement finally you know before school started today um and we can't forget what's been done and all all the victories that we've had you know I can think a couple months ago you know the conversation was different and and and it felt like a victory you know but I know it's a part of this process and I know that um you know there's no easy uh handbook to say this is how you open you know a way this is how you open a school after a pandemic when you've had so much loss it's almost like a morning and then trying to come out of that and so just honoring that um space and time I'm happy

181that a lot of our community has um been able to get vac vaccinated um you know I I also hold that other hat in our community as a public information officer with the emergency Operation Center so I do want to put out there in this public meeting there are vaccination appointments available uh sec free.org in English and in ESP espol there are vaccines available we were blessed as a county to receive many of them a couple weeks ago we couldn't we couldn't say that so if you don't have your vaccine yet make your appointment um and you know I also heard Joselyn mentioned june8 you know and it makes me happy because if we can come up with an agreement by June 8th yes let's do it right if we can uh prevent having to

182go through what we went through uh these past three weeks I I'm I'm looking forward to that um and with that uh vice president GTO mentioned the uh press conference that uh Cindy Chavez our uh supervisor Cindy Chavez held today at San Antonio um and I also want to you know thank her and her leadership and coming out to our school our home here at elmrock to host that uh press conference you know for reopening of our schools um and so with that I'm going to just close up my comments with what um I mentioned there um and we'll move on from there as many of you know I am the pro parent of sitali a sixth grader in our district who with excitement nervousness and curiosity will be walking through the doors of junior

183high for the first time what a joyous day we have all been waiting anxiously with anticipation to see here and feel the presence of the children in our lonely schools and here we are today I am proud to belong to a district who works Works diligently to soon have all of our children back into the classrooms I acknowledge our community and district has overcome a lot this past year and I want to assure you that we as a district have taken all the precautions necessary to ensure the safety of our arusd family as your school board president I will continue to show up and serve the children and families of elen rock and support our teachers and staff so they have what they need to continue the to continue to be the best teach teachers

184in our County with all of our teachers staff families and other partners in our community I have no doubt that all of our children will soon be able to learn play and Thrive together in person as a child should thank you and with that we'll go ahead and move on to item 501 facilities repurposing advisory committee update information only Dr Bower yeah and before I turn it over to Mr Sanchez uh board president I um I forgot some very some very important group that made also um things happen today in those word of the site principles who went around trying to get everything ready for today and um I want to thank them for that uh work that they did between yesterday and today make it happen made it made it happen um thank you

185to all of them uh principls and assistant principls and everybody in the district office who went around making sure that we were ready for today so thank you very much with that I'm going to turn it over to Mr Sanchez for a brief uh report on the facilities repurposing advisory committee thank you thank you superintendent Bower uh president erera loera um I did want to ask to to see if Miss Natalie Abal was um present I know she had a family emergency she's our co-chair and she was going to share the report with you um if she's not available then I will share that uh Mr Moran or marel if you can uh see if Natalie is on board president I'm looking for her I doesn't appear that she's on if if Natalie AB Bal

186if you are there please raise your hand that would help sounds like you you got it Mr Sanchez no problem no problem uh I did communicate with her earlier today I know she had a family emergency um thank you again uh for taking the time uh we wanted to give you a brief update of um the work that's been going on uh for the last few months um with the establishment of the facility repurposing advisory committee by the board of Education um January 14 2021 a process began that will ultimately lead to the preparation and recommendations that address the facility related Financial impacts of the district's continuing declining enrollment today the committee has met eight times including one Community Forum the committee anticipates a minimum of three additional meetings including an additional Community Forum to

187finalize the recommendations um before their plan presentation to the board the committee has diligently pressed forward towards the development of action recommendations with three members having presented written suggestions for committee review and comment it each containing consolidation and repurposing suggestions preliminary the committee has used the following base criteria to develop the recommendations currently most underuse sites campuses with the most severe anticipated and enrollment drops over the next six years uh Charter School proximity and the ability to retain students specific program offerings cost of operating versus enrollment repurposing potentials path of travel concerns the work has also led to the creation of a list of possible reuse options uh some of those suggestions include health clinics homeless shelter daycare Community Support Tech Center Senior Housing alternate education use for example community colleges uh other higher education

188uh Community awareness and support programs adult education a community arts program uh the creation of uh sustainable income stream opportunities through business Partnerships teacher housing possibly nonprofit use opportunities construction industry apprenticeship programs and training sites additional and valuable input was also gathered at the March 25th Community Forum 25 community members spoke at the zoom meeting with an additional 13 comments that were received um via a dedicated portal by The District's website many of these comments had a site specific Focus While others identified other important issues for committe consideration such as educational program consolidations uh alternative alternate fun raising efforts to address the budget shortfalls consideration of racial equity and review process and an examination of School academic rankings as part of the committee's work these comments and suggestions were appraised on the April 1st uh

189committee meeting as part of the larger information gathering as the date for recommendations to be submitted to the board approaches the committee has developed a strategy that allows for detailed input from each Committee Member working from a draft um Board of Education repurposing report format each Committee Member are is working on producing their individual version of the report for the committee to consider at our next meeting on April 22nd this compilation will be reviewed with an additional review session uh with a final set of recommendations that will then be brought forward for the board to consider um this is just a brief summary of the work that has happened in the last eight meetings over the last two months um any questions thank you Mr Sanchez um at this point we'll open it up for

190a public comment and then come back to the board with their questions and comments um Mr Moran help us yes is there anybody on the wishing to address address the board yes board President we have Michael Poland welcome Michael as soon as you begin speaking the timer will begin Mr poing please unmute yourself maybe we can go if there's any other speakers and we can come back to him yes the next speaker is FL de Leon welcome Mr Leon as soon as you begin speaking the timer will begin uh can you hear me yes good evening everyone my name is FL de Leon I am a part of Renaissance Fisher uh I just want to say that I uh I recently started to get involved in this committee because I think it's very important when

191you're talking about repurposing of of the schools and I noticed that some of the some of the members don't even understand the culture of our schools and their suggestions are not really like uh like understandable like for example someone suggesting to merge uh a Delante with uh uh with with dorsa you know and adante only accepts a it's a dual academic or a dual uh school so I think other things that I hear and and I heard that report that Rene just did is that a lot of times uh when when um well what one of the things that I noticed to that all the comments of the parents the people that is going to be affected if they school closes you know all on all the comments that were done nobody ever say close

192the schools and we're we were hearing about closing a a couple of the schools and I I heard some of the the the the members of the committee also say that they didn't want it to mention that uh any school uh or Target any school to be closed and I think they also um uh were trying to make modifications on the draft and some guy name art was saying oh we should not change any any anything on on the draft you know and if you guys are having a committee the committee is there to give you suggestions and listen to it not just come with a draft that you are working and I know Ren says that some of the members are going to be working on bringing some suggestions but I think it's very

193important that we are not willing to see schools closures and there should be repurposing of finding different ways of how do we use that installations so we don't keep losing students because we might lose as students if they are not liking what are the modifications going to be thank you thank you um Mr Mandu we can try the person that was weall first again yes Michael polling Michael polling are you there we're gonna um count to five and if you don't come on I'm going to assume it was on the previous item and maybe you are um not here right now if you can unmute yourself and let us know that you're here okay so I take it uh he might have uh maybe raised his hand in the previous item that hand was up

194for a while I think it might have just been a Remnant yeah so um we'll move on Mr Moran do we have anybody else we have one more that just popped up Adrian vain welcome Adrian as soon as you begin speaking the Tamer will begin hello thank you again um one of the things I noticed um and this will be about what we're talking about is that you guys are going to be talking about uh building a soccer field and why why are we focusing on spending money on other sites when we have sites that you guys want to close down we need to look at what are we going to do how can we reuse these sites so we don't have to give them to other people we need healthare sites we need need

195sites where people can daycare we need to start looking at what we can do to keep our district together keep our community together without having to give it to other people and if I I I just in a little sort of like why are we looking at doing a soccer field when we are talking about closing schools down that's that's something that just sort of worries me let's focus on how can we make things better and thank you for your time I appreciate it thank you thank you thank you Mr Moran do we have anybody else no more speakers thank you um with that we'll move on to trustees any questions comments trustees please raise your hand at this time none okay um seea okay trano there we go okay uh yeah just um you

196know briefly I wanted to to thank the work of the the committee you know I've I've been able to watch every meeting thanks to our YouTube replays and so I'm very aware of the processes that they're going through the um you know the very difficult and challenging kinds of decisions they'll you know are working towards and making a recommendation um you know having been here for the past couple of years now I completely understand the difficulty that presents that is presented to an individual when they are passed with making decisions that um you know have impacts that may may be a win on one side and another side not so much um but you know that's I look forward to you know whatever comes to us um because we as a board will need to

197make some kind of a decision on the future of our district I think over the past months we've seen you know we've seen our demographic study we've had communic ation with um the County Office of Ed in terms of coming up with a plan to address our our budget challenges um we've we've had a number of different things that have pointed Us in the direction that we need to make some very difficult decisions in the coming um you know shorsh amount of time and so the the reason why this is it's imperative that these decisions will need to be made is because you time is of the essence potential impacts well not potential there's very real impacts on budget in terms of expenditures of money going out and potential money coming in and so that

198those are dollars that we need in this district and the way that we are currently configured I mean that's a large part of why we are in this current situation so it's very clear that some concrete decisions will need to be made and and that's the work of a board the Advisory Group I you know I look forward to them continuing to kind of hone it down to what their recommendation will be once they bring their recommendation here then you know we as a board will consider their recommendation or recommendations and um you know hopefully move forward on something that continues our district moving in the right direction I also want to um acknowledge uh Mr Sanchez and Mr Han for facilitating those meetings I know it's a you know it's a short time that

199a lot of work is done during those meetings it's not a long meeting and it's it's well facilitated to keep an eye on on time and get as much information in that amount of time and I also am appreciative of uh Mr Hand and Mr Sanchez making sure that the documentation that is presented um or that is being worked on is um adhering to the legal language that needs to be used I understand you know I myself and sometimes we question some of our resolutions or some csba language in our policies and and it's okay to do that and look at that but also understanding that the the legal language is there for a reason to keep our district um you know in line with the way that we need to present information so I

200want to thank um the facilitators for that as well so again I'm hopeful to see a recommend soon and a decision um made at that level to bring that recommendation and and I'm I'm not eager to making a difficult decision at some point I'm not eager to do that but I am eager to doing what we need to do to make sure that we are remain solvent and beyond that hopefully we can begin to um you know get into the positive and and and work more in that direction so those are my comments on this item thank you thank you trusty fam okay well uh I too want to concur with uh the comments of my uh colleague Tristy Beano there uh I want to thank uh Renee and the committee for for their work

201too uh it is certainly I know will be a contentious issue that we will be faced with in the near future but I do for my part I do want to to assure the community that uh I and I I hope my colleagues will be working to minimize any impact that this decision will have on students and families uh just to give a an example of what why it is important I want to pull forward and reading re from the audit uh you know we've had near you know on I believe page 10 we've had nearly nearly $8 million worth of uh depreciation from our Uh current and capital assets then that is the cost of maintaining a school district uh I you know even on the outside you know I when I was a

202student when I parent took me to school and just like you know every day our families take to send their kids to school you know behind the scenes there's a lot of things that have to be done not just during the school day but also uh beyond the school day uh roofs leak uh asphalt cracks pipes burst uh there's vandalism and I can say so as a previously a vice chair of the bond committee uh we have the moxa building adjacent to Matson middle school and uh when when when the committee came to to visit the Matson site and the MOX doting uh there was traces of vandalism broken windows PE people broke in in the middle of the night and actually took some copper wiring and you know the cost of maintaining facilities has

203a impact on the uh solvency of our district and our ability to provide an education uh so you know I you know it is a you know it is a decision that's going to be fraught with uh you know the voices of many parents and I understand that there's a loyalty to to site too I myself have some loyalty to certain site but but you know we hope that by eventually when we hear the report where we can chart a course of action where we preserve as many as possible minimize the disruption and hopefully where we can uh gener you know if possible generate some income that balance out the costs of annual depreciation uh you know that is a whole in the district's budget so uh again thank you very much Renee and the

204school facilities repurposing committee for your work thank you trusty fam anybody else okay uh yeah vice president Bo president um I want to thank the committee for the work they've done I know that um it's a lot of effort a lot of meetings that you've gone through and I I um I appreciate the work that you've done it's a difficult it's a very very challenging uh topic be ideal if it was always fun and excitement to take on things but I do appreciate uh the thought and the foresight that's been put forward by uh some of the members in particular uh the um president JN Merz who put out some very very excellent uh recommendations that I've uh I've looked at and scrutinized thoroughly and I'm looking forward to having some dialogue whenever it is

205that a recommendations do come forward and take everybody's position into into account in particular I do appreciate uh the ideas that were put forward by by Joselyn so thank you very much to everybody who's been uh doing the work on the committe thank you you um trano I see your hand up yeah that when uh Joselyn brought up the you know her proposal I thought that was very interesting and and you know it could you know it's something that I think some of us have version of that as well so I think maybe we there may be some kind of parallel by some some people and so so I want to you know that just to that proc that committee and how through dialogue and through going back and forth that you know we can

206hopefully get to some some Innovative creative um solutions that might help us address this and I also I forgot to say this part that um I I want to make sure that you know not everyone is familiar with all the details of every single site in that committee some members maybe are parents or community members who don't have direct specific knowledge of every single site but um you know the purpose of that stakeholder committee is to bring perspectives from a variety of different areas so I want to make sure that to continue to encourage um you know people to feel that they can contribute and and put something out there and and if it doesn't make sense that's the purpose of the group to work through that and get to something that does and so

207um in that Spirit again I thank everyone for the Contin participation in that group mute thank you trusty uh at this time um I don't see any hands so I'm gonna go ahead and go with my uh comments and recom um or questions um I see your hand trusty Chavis we'll come back to you after mine um so I Mr Sanchez I heard that there was some recommendations I personally have been um respecting that that space and time of the live meeting because I want to make sure that I don't you know show up and guide the conversation in any way or have any thoughts I want to make sure that when I hear the recommendation um you know I didn't have any type of uh of input um at the time so I just

208want to respect that space and um and the committee um a very uh special leaders that their committees picked to be there um so I know we've already said it but thank you all for your time it's a tough tough tough uh place to be um tough committee to be on so um I'll start with my first question um what are the recommendations that are at the table that they're considering at this time do we have any I wouldn't I wouldn't say their recommendations these are suggestions there have been three suggestions that have been brought up um I I I don't have them right in front of me but I can definitely share those um the idea is that all of them will be bringing their final suggestions at the next meeting we will be

209discussing those and then we will be proposing a recommendation for the board and it may take the form of one two or three different options okay um my my request is that if there are three options let's say there's three options that the committee you know puts the options in the in rating right this is our option uh number one two and three um as to how they would prefer it um just my personal preference um and if they're all the same and they all feel the same way about all of them then that's great as well um I heard I was gonna ask by when we would have that so I heard that you would all come up with it by April 22nd is that correct we're working on trying to have that um

210finished on April 22nd I'm hoping that the committee can get get together and be able to come up with uh final recommendations at that next meeting next week thank you um and and actually then my request is that um it's done by the end of the month I don't know if they need another meeting prior I'm not sure how many um what days they meet or you know how many Thursdays or Wednesdays are available between now and the end of the month um and the reason for that is Dr Bower um I'm trying to think back it's so many details in the timeline and all that um we're looking to make uh as a board looking at that and making those tough decisions right we all have a piece of them um by May right

211our um we're looking at May ma board so then that means that we if we have a recommendation um presented to us that maybe then we um get to look at our calendars to have a possible special board meeting by the end of the month Dr Bower I just want to remind everybody uh and I I double check with roel about this because this is very important for everybody to know the recommendation is to be brought to the board by May so that family pleas know you know know whoever is going to families and staff that will be impacted by any decision need to be told and so there needs to be some time before May and that's the reason of why it's important to do it either by the end of the month of

212April or early May because we have we need to have time to go and alert those people that are going to be affected one way or the other and then then finally it bring the final recommendation to the board so there are milestones in the process and all of this is governed by Ed code um the committee was reminded of that at the very beginning you know of the of of the the law that governs their work and so that's something very important um for people if they want a refresher the early notes of that committee you people need to go and review them because it's not these are not arbitrary milestones in the process we have to follow these things and so it's not about oh we'll just bring to the board an you

213know a recommendation by next year or anything like that the other major uh concern for this district is that um the budget needs to be presented to the board by June and so the board has received an an uh comments from Santa Clara County Office of Ed that we must present a savings plan in order for our budget to be positive we can no longer wait the uh the structural deficit you know a lot of people want to know about the covid money and I we will bring the the information regarding the Cooney money but those are onetime only funds they are not part of the ongoing budget and so we as a district are not able to solve for the structural deficit created by the declining enrollment if we don't present a plans a

214plans of savings so those are very difficult decisions for all of us and we need to be mindful you know you have you keep you know these are not not a popular decisions and this is these are significant uh decisions the Board needs to make so that we can keep the district afloat uh so I just want to make sure that everybody remembers that and I also want to remind everybody um a lot of times people say how do you spend the money CA has brought numerous times during budget presentation detailed information there are books published for you and the community to know how the money has been spent so I just want to refer to those um sources that are online for anybody to go and look at them and check and see how

215the the district funds have been spent so just a friendly reminder it this you know this we're following that code we have to do these decisions and we need uh this is the time to do that thank you thank thank you Dr bow and um Mr Sanchez I heard you mentioned a lot of ideas that they've talked about for these sites um but I think also I just want to reiterate that we can't have those conversations or make those decisions before we make the hard decisions right so that's great that they're having these conversations um you know thank you for that report but I and I'm not there so I appreciate the reports but I'm concerned that they're having kind kind of the conversations of the you know Carriage before the horse or whatever you

216know however you say that saying like we can't have the conversations about what's going to happen with these sites if we can't have the hard conversations about which sites one two three 10 I don't know but I think just a reminder I mean you know those are great ideas you know and we've heard wonderful ideas and some of us have great ideas but those ideas mean nothing nothing until we have those hard conversations so um I I heard you say April 22nd I was excited and then when I asked you you kind of were like H that's what I'm hoping so as you know board president um hearing you know what Dr Boward just talked about um we need to have that recommendation by the end of the month otherwise right because I want to

217have their input we're gonna have to make that decision possibly without that recommendation and that's not where I want to go as a board um so hopefully that recommendation comes um you know I don't know we get to schedule a special board meeting maybe we might not need to we can have it in May and we'll have that conversation eventually and I'm sure we'll check in with the board if we need to set up a special board meeting but I really hope that that recommendation comes um to the table on April 22nd and with that I saw trusty fam and trusty Chavis hands up so we'll go to trusty fam and then trusty Chavis you're muted Mr fam okay now can you hear me hello I yeah okay very good so uh you know there

218was a I recall there was previous um public comment uh regard you know on this item and she mentioned the tabled item which was 6.01 the the the soccer field Pro project at least you know I how I read it was that the soccer field was is not being built with District funds so therefore it it has no impact on the district so uh question to Dr Bower uh could could you ex you know in a nutshell explain to the community that uh this soccer field is a net benefit to the district and that the district district is not spending funds on on this field you're correct it's a it needs a mini pitch so I want to make sure that people know this is not you know I'm I'm sorry to interrupt Dr V

219but since we took it off the agenda can we still talk about it and thank you trusty no you okay yeah it's off the agenda oh okay of the agenda I didn't know if the original agenda was what held Pres there So eventually Mr fam will'll talk about the details on that but now it's not on the T table not an option any other before we move on to trusty Chavez Mr fam you're done yes yes okay trusty Chavez okay umina say you were asking if there was a one two three recommendation um so I would strongly urge you to see all of the facility these meetings that did go on because somebody did ask your the same exact question and they don't want it depending on how it's listed to for people to think

220that they have priority for the one that's listed first when in actuality that may not be the case so I think that if we do get a budget meeting going sooner uh so to help also uh in making the decision of the repurposing of the facilities um that would be very helpful if Dr Bower if we could schedule something uh tonight this evening uh even though if one of us can't make it that's okay um let's just get something so that uh we can maybe talk about um the budget as we're thinking of repurposing thank you anybody else before we move on okay seean thank you uh Mr Sanchez and we look forward to hearing the recommendation um as I look forward to hopefully having it by April 22nd and at our next meeting whoops

221I have one more question uh I should have followed up with Dr Bower can we make sure we do that uh meeting and plan it at least have a date tonight if if that that's just a yes or no question thank you I'm sorry trusty Chavez I know you kind of mentioned about having a budget meeting with the to make the the so I think those are two very separate ones I'm not um okay so on the on the facilities some facilities cost us a lot more to maintain will cost us a lot more to repair will cost us a lot more in the long run to run that facility even though it may have lower Adas and you might be just thinking about about the low Adas I think if you see all of

222the meetings of the facilities they mention a lot of that you know how much uh is being uh how much for per student they're serving the ones that they're serving how much it's costing them because all Sites have all different uh numbers so in another budget committee that could answer a lot of the questions and answer them before we actually start thinking repurpose this one repurpose that one I think it'll be just more fair not only to the people who work at the sites it'll be fairer if they think that we actually did more homework in looking at all these facilities meetings hearing all their concerns weighing in on that instead of just bringing it all to at the end and making the decision I just think uh oh uh oh you I you muted

223I'm not sure why um I appreciate all of the time and effort that the people in the facilities meeting has have done and I want to make sure that uh we take that into account and not just you know say this is this is the one that's not the one like that okay okay now I understand thank you for explaining and so I think that's a great idea um but I personally I don't see it being done at a budget meeting I see it being done at the repurposing committee meeting and so if that information can go to them because they are the ones that will make those decisions at the end of the day uh because even let's say we schedule one for Monday um I don't know I'm just throwing out the the

224the date I don't know that that information will will go there prior to the 22nd um go ahead trist chis that's not what I'm saying what I'm saying that the information that you get that people will get from the budget meeting that will also help us make the decision for the re purpos because those questions are going to be asked as well as if you hear all of the meetings of the what questions they've been asking it all has to come down to the budget if we can clarify some stuff and knock out the one the stuff that we don't think is going to be essential but this other part of the discussion is essential then why not have a budget meeting I hear you and I think that information is essential how ever I

225at the end of the day whether it's in May whether it's in April when we make that decision I get to hear that information right so that information should come to those who are and I'm not saying don't have a budget meeting that's not my area definitely have it but I don't think that that I think that information needs to come to the committee who's going to be making the that recommendation to the board and also I'd like to get that information because I think it's important information when we make that vote that that information should come to the board for when the day comes for us to vote on which site um so I I think you should have a a budget committee but I think that we need to focus on this repurposing

226advisory committee I think each one of them need to have that information um I personally don't know that they'd be able to go to the budget meeting and that meeting and maybe they can and that's great but I think regardless those that are a part of the advisory committee should have that information with them on Thursday the 22nd whatever the day that falls to make that decision um trusty travez okay you know what I want to say Alam Rock does a wonderful job of spending the money on having Zoom meetings on getting the information out on YouTube all these meetings are all on the website and that's the good thing that we can all be informed by putting in a little extra time at every meeting you don't have to say anything you don't have

227to put your input but you're going to get a lot more information and a lot more knowledge about what's happening in the schools by visiting the facilities Committee just because you can't say nothing doesn't mean that you're not absorbing all that information and getting knowledge I'm just saying to have one even if for five or 10 minutes if nobody you know has any questions then nobody has any questions but if it's an hour that some people need to to help them process what's going to happen later because I kept hearing over and over the teachers say you need a plan you have to do it well in advance put more time and effort into it this is would be more time and effort in trying to make a fair decision for everybody involved it's just

228not about closing School it's about people's lives the people who work there the parents you know it just why not he a little bit more input is what I'm saying and and since it all comes down to money yes the money has a lot to do with it let's let's have a meeting and I never got that answer from Dr Bower if that was a yes or no thank you I'm not putting it on the spot but it'd be nice to have that answer so I I may I answer question I wanted to answer privately for trusty Chavez but is it is it okay trusty ER yes please Dr bow so when they I check with roio uh because there has been an issue with with times and things like that the bylaw says that

229the the the board subcommittees are two members and so there should there cannot be a meeting without one of them so I will follow up with trusty Chavez and trusty Beano I think I need to talk to both of them about that and I just wanted the public to know why we cannot have a budget committee meeting of the board with only one trustee thank you thank you Dr B trusty Verano and and just quickly to I wanted to confirm some um just with some of the information that was thrown out as well um and Mr changen if if you know if you feel there's anything you can add to this please feel free to jump in um but at the time you know when when trusty Chavez had initially requested this meeting we we

230did not have any additional information than what we had already presented both at a open uh a regular board meeting where the budget had been presented and at our last budget subcommittee meeting so we presented the same information I believe um twice to the community we made that public um and at the time of the initial request it was I believe expressed to us as a committee that there would not be any new information until after we finish negotiations then we would have an idea of the covid monies and and more of an idea of how those would be allocated and after or around the time of the May Revis when we would have more updated information so one of the reasons why I've um been considering the timeline for when to have the next

231budget meeting is because I don't want families parents anyone IND anyone who's interested to come with questions and be frustrated because we can't answer those questions because either negotiations were going on or we didn't have any updated information so that's why I know I understand the urgency that um trusty Chavez feels and and you know I think maybe her style is to try to immediately address those things and that's not necess necessarily a bad thing I just come from a more of a perspective of being um a little bit more strategic longer term thinking and so um I I as I mentioned to trusty Chavez the moment we have updated information that will be able to address the questions that the community can have in terms of the covid monies in terms of updated May

232revise information absolutely let's have that meeting and and do that but I just didn't I was um you know not sure of the of the usefulness of having a meeting that we had already presented information to and bringing people in with questions that we couldn't answer so I don't know Mr Chang if there's anything maybe I'm I'm mistaken in some of that but if you could either confirm or correct um that might be helpful and I know this isn't the topic but since we're talking it is I do see trusty Travis's point of kind of trying to make that connection so I think it's valid to spend a little bit of time here um that's my opinion Mr changen or uh board vice president kto do you want to say something before Mr no I'll

233look forward to the response and then I'll I'll speak up okay uh Mr Chang and then we'll come back to you okay thank you madam president um yeah just to um capture um board member Beano um that was a ation we had uh you may recall that our second interim was presented uh I believe on March 11th and so at that point um you know having a budget meeting right now um there are some um information but not NE nothing significant the bulk of the information or new information is going to be made available um in the May Revis itself and so um I believe that I mean having little information to share with the public and the Community right now um would do it more a disservice in terms of causing more confusion um

234rather than wait and have all the information available to us so that we can capture that in in our budget presentation um and give it the whole big picture not just itss and bits and just what is in a very rough estimation what's the soonest that we could have a meeting that would include that updated information and potentially some of that covid information if that could be R WRA wrapped into that presentation when might we be able to get so um you know as you know at at the state level um there's there's negotiation as with the legislators in terms of um some of the funding that has been proposed um from the January budget proposal and also you know some of the things that's happened related to um AB um ab86 that just recently

235got approved approv so that's that's a little bit of new information that we can share um but other than that um uh part of the the the May reice can reveal um the details um of what the federal planning um spending plan is going to be um in addition to that they're going to flush out all the proposals because right now I mean they're they're they're proposals and they nothing um have been decided yet so there's still negotiation going on um until the May revision when the May revision is being presented um typically that's where a lot of school districts um rely on in terms of information um to be able to prepare their budget for the upcoming year thank you Mr uh board vice president K so um Dr Ramon Martinez a very well-known

236educator in Ean Jose education leader in Ean Jose uh once told me a story he said that the late Ernesto galara uh he he met him at San Jose State when he was a student and uh asked him to tell him something smart right before he took off to a meeting he says I was a young guy back then and he said uh don't go to that meeting unless you expect to go to other meetings as a result of that meeting and so with that being said bureaucracy already meetings he said don't to that meeting what unless you expect to go to 10 other meetings related to that meeting he just foreshadowing the fact that bureaucracy standard operating procedures always be get more and more meetings so I do appreciate uh a board member the

237fact that you being about the um the amount of time that people are going to be spending and that holding meetings just for the sake of holding meetings to say you did something is a is a complete disservice to the public and so thank you for the thoughtfulness and staff appreciate the information because I was also concerned about you know why is it that there isn't a budget meeting it's being called you know it must be beneficial and so with this background I myself I'm appreciative of the fact that you gave it a lot of thought as to holding a meeting when it makes sense and when there's information to provide not just holding a meeting for the sake of holding a meeting so do appreciate that thank you uh vice president kto trusty Chavez

238people keep asking over and over all the budget questions so if we can't get one through the district I would like to request one with uh Mr CA Chang is that possible I see Dr bar not you can have oneon-one with with CA [Music] yes and then I just want to I I also heard um members of the public and I also heard vice president GTO specifically ask for the co money budget um that will be presented trusty Chavez so um I know I know I know the presentations are coming when you have the information go ahead trusty Chavez and if it takes 10 meetings to answer people questions then I'm willing to do 10 meetings thank you thank you trusty Chavez um all right thank you Mr Sanchez I'm sorry president yes goad sorry

239I just want to be very clear that um trusty Chavez you will have a oneon-one meeting with okay all right thank you okay thank you um and just to come back Mr Sanchez thank you so much for your patience and going off topic here uh but I know that I requested um that we get a recommendation uh that hopefully April 22nd that comes um because I I want as a board member I want to make my vote based on what the community says I want to hear my community um and that means that we get to hear that you know that whatever they recommend and so but if we don't have that information then we're still going to have to or get to we still get to um you know make that vote and make

240those decisions um at some point which we have the idea of the of the timelines and things like that um but yeah thank you again uh thank you for you know and and Miss Natalie U for co-chairing that I know it's not easy um and so I look forward to hearing more from your group thank you so much thank you and with that we'll go ahead and move on to item 502 um and after this item um um uh actually let's let's go through and then maybe yeah let's go through and then we'll see I think we need a a break soon but um item 4502 Dr Bower is somebody gonna be presenting that yes that's my item yeah uh president I want to thank uh the board and everyone for allowing me the opportunity

241to go ahead and present uh this resolution uh opposing the use and sale of ecigarettes and electronic VAP devices the whereases is quite extensive um so I won't go ahead and go through every single one uh it's a lot of information regarding um the statistics around the dangers of of vaping ecigarettes and those type of things and then also flavored tobacco and the danger that it poses to young people in particular uh because it it entices them to go ahead and start uh using tobacco and then ultimately jump over to actual paper tobacco or to actual tobacco products not The Vaping ones but cigarettes stuff of that sort and so I wanted to go ahead and present this resolution in support or asking uh the city council to use its regul regulatory authority to take

242urgent action to amend the city of s tobacco retailer license program to address the following and I'll just read uh seven points that that are part of the requests that are laid out in this resolution so if you think this is long then you know be grateful that I held off on on the 20s something waras is that our chalk full of a lot of good information you can go ahead and access via the board book on our on our on our website but uh we're this request this resolution is if adopted and if you has support my colleagues we'll seek to one prohibit the sale manufacture and distribution of flavored tobacco products including including Menthol I prohibit the sale manufactur and distribution of ecigarettes and electronic vaping devices prohibit the sale of tobacco products

243and pharmacies set a minimum price and minimum pack size for sale restrict the marketing including social media marketing product placement coupons and promotional materials and self-service displays of tobacco products in and from retailers uh and six uh reduce the concentration and density of tobacco stores and seven prohibit a tobacco retailer license from being issued to or renewed or a business operating too close to a school or other area frequented uh by youth so it be a further resolve that the governing board of alrock Union School District will adopt a policy that specifically prohibits ecigarettes anywhere in District owned or leased buildings on school or District property and in District Vehicles we had further resolved that the governing board of alrock Union School District will explore policies related to Prov providing ecigarette and electronic vaping device

244prevention and intervention services for district students and so that is uh those are the the requests via this resolution uh unfortunately um these ecigarettes have become incredibly popular and they're being used by younger and younger uh students uh that are now admitting to using these devices and unfortunately the fact that it's a an electronic device the fact that it's not being actually burnt um makes people think that they're somehow more safer uh when in fact we've heard the news of those chemicals that were found in cartridges are being used by many people throughout the country some of them here in California that wound up uh either getting irreparable harm to their lungs or dying as a result of using uh these electronic cigarettes so with that said I would ask my colleagues for anous support

245uh in moving forward with this resolution and I would ask the administration if if adopted to please forward it to the entire city council as well as the mayor of City s thank you so you motion to approve motion to approve all second Put It Forward second by I know I heard first um so any questions or actually let's open it up for public comment first uh Mr Moran do we have anybody on this item who would like to address the board Bo president I don't see any hands up okay we'll go ahead and move on to our trustees any questions comments on this item hear you I can't hear you can't hear me I can hear you loud and clear fine you can't hear well she said yes so I'm I'm not sure okay

246uh trusty Chavis let me know if you maybe it's your audio you might want to check I'll send you a text um tryano you have a comment or question uh both actually uh number one I I might have missed this in your brief presentation trusty kto but is there a particular reason why we would forward this to the city and and not um to the County Board of Supervisors or is this specific uh because the city has that uh particular um regulatory Authority um and you know we can go ahead and and refer the same thing uh to the county um obviously it would take a fullon other resolution to amend it a new resolution to send it with u directly addressed to the county and I'm glad to do that but we can send

247this one as well right now to the County Board of supervisor okay thank you for that so yeah I I'll definitely be supporting this um you know a number of years ago when I was working for the Behavioral Health Department doing drug and alcohol prevention these um you know vaping was kind of getting started and it's just exploded since then I mean I think we all know that I I know that my own daughters and and Junior High and Elementary School I mean middle school and Elementary School would tell me that kind of stuff was going on when it was early on and and it's expanded so I definitely will be supportive of of this and thank you for bringing this to us just thank you anybody else comments question Mr F yes uh you

248know and I'd like to thank uh vice president quo for bringing this forward you know in light of uh our pandemic which is a respiratory pandemic uh lung disease whether from tobacco and vaping products are a contributing factor to the deadliness of this pandemic and whatever we can do to reduce the riskk factors for covid because let's face it even with vaccinations we were going to live with covid for a while it's going to it looks like epidemically like the flu it's going to be something that we will have to live with for year for years on out so uh where we can protect our kids from lung damage I'm all for it so I urge a yes vote on the motion thank you thank you trusty fam um yes and thank you uh board

249vice president kto for bringing that um as a probation officer you know I've seen too many youth get sucked into the substance use by way of you know um smoking um and in this case you know like you mentioned being that it's a device that they don't see burning um it's even easier to get sucked in and then with the different uh flavors that they have out there um even more of a uh of a weigh in for some of our kids that maybe originally would not have tried other things like um just straight tobacco and so thank you this is so important um also for our our parents and um and Guardians out there right that are not um might not know about some of these things um to to bring this awareness here

250today thank you uh for doing that and I look forward to also uh supporting this tonight so with that if I don't see any more hands we'll go ahead and go to the vote uh we'll start off with trusty Verano I trusty Chavez hi trusty fam hi board vice president g i and myself I passes unanimously thank you um and we we'll go to to the next item and after this next item we'll take a five minute break I know we've gone four hours straight in meeting so after this next item we'll take a five minute fire Break um so uh for now we'll do um and uh trust I'm sorry uh bow are you gonna be presenting on this or do we just move forward I can move it forward to I'd like to

251make a nomination when the time when let's do it I think it's time okay uh my computer turned off on me but so I'd like to make actually a sole nomination of of andreo on this item um I think that it behooves us as a district to increase our chances of of having our interest represented at that level and so um strategically I think it makes sense in this instance although I think you know my vote and our vote as a district last time showed where our support was but I think for this particular item I will nominate um solely andrees to represent um our district for us for this thank you trusty and um before we move to a second um I'm wondering for that same reason I was thinking the same but for

252that same reason would you be open because we can vote up to two for Van Lee who is also a representative of our East Side Community on this well so my motion yeah my motion is is a sole motion for the reason like I said I I think that um I spoke to my thoughts about vanley at the last time and so this does not diminish those thoughts but I think in terms of just trying to get our representative at the table it it it is in our best interest to make the sole nomination um and I I'm verbally supportive of trustee um Lee from side Union because I think it's the same concept that is important to us as a district but I'm more inclined to have our direct a direct representative from our

253district and increase the likelihood that that would occur so my my nomination is so thank you makes sense yes I second um the nomination um JY fam well I was going to Second too but you know uh purposes of moving it Forward uh Second and then we'll go to public comment and if it's okay to come back after that you oh okay very well very well okay so we'll go ahead and open it up for public comment at this time um Mr Moran do we have anybody from the public who wish to address the board this time we have no public comment okay thank you uh trusty fam uh you know uh you know given the situation we are in uh I support the motion because although I I remember voting in support of both

254uh this is a runoff election and we need a strong voice at a table for our district and having worked with Andres for for years uh there's no one I would trust more in that position on behalf of our district and on behalf of East East San Jose than him so I UR yes vote on the motion thank you Mr fam um and with that if I don't see anybody else's hand go up we'll go ahead and go to the vote uh so we'll go ahead and start with trusty veano I trusty fam I trusty Chavez trusty Chavez okay um I think she's maybe took her break early on uh vice president Kinto hi and myself I passes and at this time uh we'll go ahead and take a five minute break it is 9

255let's say 34 we'll see you back here at 9:39 right yes 5 minutes see you in five minutes Mar um I'm not sure if you're there um but if we can I just got a text from trusty Chavez if we can bring her back in oh wait she's in here I see her there um in can you hear me okay good I just got your text I wasn't sure what it meant I yeah I I texted you before the discussion it went oh God okay sorry so that was if you check sure I got this break and I'm like let me check my text during my break and I got well I'm glad you're here okay okay iing say it again pardon what what number you on uh so we are calling our meeting back

256to order at 9:39 or coming back from our our break okay but what what number you on I'm gonna get there right now but before we get there I just want to confirm I do see veano um I saw GTO come on I hear you Chavez and Mr fam um and so we're all here uh with that we'll move on to item 602 thank you and uh Dr Bower um I'm gonna turn it over to um Mr Chang perfect thank you yes thank you Dr bar um at this time I would like to introduce Mr Charles Ry um from Crow he'll be presenting the20 audit report uh Mr Moran if you can provide access to Mr rley um to be able to thank you hi there I trust you can see me okay hello yes

257welcome okay so it seems like everyone you know we're trying to figure out how to use these Zoom features uh you know I think I'm an expert and then I get you know corrected but I think I got it down okay can you see that presentation slide intro yes so so uh appreciate the opportunity to very briefly discuss the June 30 2020 uh fiscal year audit uh we're meeting a little later than we have historically and that's a um intentional change I should say um during uh the 2020 you know pandemic that we've been all dealing with uh the State Controllers Office provided an automatic extension for all districts in the state from the normal due date of December 15th to March 31st uh of the Year following your fiscal year um and so the

258audit reports for many districts in the state were completed a little bit later allowed extra time for the fiscal services and other groups to be able to provide audit information uh that we need so uh we're going to meet to briefly talk about the audit um this first slide really just talks about the scope of the audit we had conducted our fiscal audit over um it's an external audit over the financial statements Federal compliance and state compliance um we incorporate um risks of material misstatements are areas that are more subjective to error in our incorporation in our audit uh methodology uh we also evaluate internal control structures that are in place um and the in the combined effect of incorporating risks of material misstatement and these internal controls assessments is a risk-based audit approach um

259we do list out here on the bottom of the slide the phases that we conducted the audit um so you can kind of see that uh progression throughout the uh interim phase of last year moving through summer and then into the uh reporting and completion that was done uh through January February and March um there's a slide here this talks about corrected and uncorrected misstatements um this is really just a summary of things that if you had a corrected misstatement which means an adjustment that we had to post two-year financial statements in order to give our opinion that would be listed here but there are no adjustments that we recorded in that regard so that's a good result um there are two what we call uncorrected misstatements which is just items that were differences in

260the audit process which are large enough for us to bring forward uh to your attention but not large enough to have to have um made an adjustment in your financial statements in order to give our audit opinion these two items are carryover uh items from the past uh few years and this is not what we would consider to be a a finding these are known items that are differences and management uh have determined and we concur that those are not material to the financial statement so one relates to the district's participation in the Medicare Medicare premium payment program um all districts are participating in this pretty much throughout the state um there's some just some disclosures and a an what they call an other post employment benefits liability uh associated with it that total at

261the end of June of 20 was 600,000 relative to your budget as a whole District um you know it's not been recorded as a liability and many districts throughout the state make the same conclusion uh to not record that the other item relates to allocating a portion of the pension or the purs C Pur liability to the fund 67 or your self Insurance Fund there's no difference on the government-wide financial statements it's just technically under the accounting standards a small portion of that should be allocated to fund 67 that that pension liability um again that all combines together to be reported as the in the district as a whole so not uh a finding as an overall uh financial statement so just something that's Carri forward on that um other Communications that we need to

262make to you all is if there were any difficulties in performing the audit disagreements with management about how to account for something in the financial statements we would let you know uh formerly in this meeting um if we had any we're made aware of any consultations that management had with how to account for something so they count consulted with another accountant if we and if they disagreed with how we told them that it should be counted for um and we would let you know as that this time um and then if there were any other significant or Adverse Events that that had an impact on the financial statements we would let you know um you know I would say that um if we had something significant we wouldn't be talking about it in this meeting

263we would be talking about it um several months ago likely during the audit process so it's a good thing that we're just briefly talking about them now because there are no items to communicate so um the audit process went really smooth relative to the uh challenges that we were all faced with having to do a lot of the audit work all of the audit work in a remote environment uh meant meetings through Zoom it meant um transferring data through our secure portal um you know and and really doing a lot of assessment of the impact of of uh remote environment during that uh period of shelters in place uh on the internal control process so really understanding what the impact was and whether there was a um change to the financial statements or the controls

264that we needed to take into account um so we didn't have any issues in that regard so the the results of the audit process here is a a unmodified opinion which is the highest level of opinion you're looking to get uh over the financial statements over Federal compliance and over State compliance I did identify the programs that we audited uh as major programs for federal compliance during FY 2020 So You Had Your Child Nutrition cluster and Title One Part A as major program so all three audit um Scopes were unmodified or or clean if you will so a good result overall um and I think the the process of of our audit um you know we've had items of you know findings I would say in the past and and um this the fiscal year

265and um have has de demonstrated that there's been improvements in the in the financial reporting uh to such that we don't have any findings that we need to communicate and I think that's a really great result um we did a a thorough audit to be able to make sure that we covered off on the areas of concern in years past and and don't have anything that we need to bring forward to you all today which is a great uh conclusion in in light of those past challenges so we didn't have any again to kind of conclude we didn't have any um adjustments that we had to post and therefore the financial statements are presented fairly in all material respects there's no audit findings related to inter internal control or federal compliance or state compliance for

266that matter um and then you know management was able to provide us the information that we needed um you know and and work around the challenges again that we had with the shelters in place and and other uh restrictions so the ultimate result is that unmodified opinion and and our last bullet here is that the uh audit report was filed with the state controller's office and your other agencies in a timely manner by the revised um March 31 reporting time timeline so happy to take any questions you may have but you know it's a good result overall and I appreciate uh CA and and and the rest of the fiscal team for all their assistance so it was great thank you so much for that uh presentation and at this time I'll go ahead and

267open it up for public comments and then come back to the trustees for questions and comments uh Mr monan do we have any uh members of the public wishing to address a board for President we have none okay thank you uh we'll come back to the trustees um any of the trustees have any questions comments um trustee fam um first of all do we make a motion to accept the uh accept the audit you're motioning to accept yes thank you second I heard both trusty and Beano and Chavez at the same time can go ahead and all right trusty Chavez so motion by trusty fam and second by trusty Chavis um thank you with that um does anybody have any questions or comments I see trusty fam's hand still up yes yes I do have

268a comment and bear with me so I am glad that I I want to say that this audit is a uh evidence is a p you know Prime piece of evidence that this this we this district is making progress towards fiscal discipline and transparency uh you know as you've heard uh the auditor mentioned uh the highest possible rating you know and uh you know to quote from to quote from page two of the audit quote in our opinion the financial statements referred to above present present fairly in all material respects the respective financial position of the governmental activities each major fund and the aggregate remaining fund information of the Alam Rock Union Elementary School District as of June 30th 2020 and the respective changes in financial position or applicable cash flows thereof for a year

269then ended in accordance with accounting principles generally accepted in the United States of America uh secondly uh I want to personally thank assistant superintendent Shang and his team uh I worked with him on while I was on the board committee and he's always done uh he and his team have always been uh open prompt and transparent about and professional about how they present uh this District's financial data and I want to spec you know specifically thank he him and his team for uh implementing three crucial findings uh the implementation of necessary internal controls to ensure the accuracy of financial reporting the implementation of necessary internal controls to ensure that classroom teacher salaries exceed the minimum required percentage of the current expense of Education in the general fund and implementing the necessary internal controls to ensure

270that the school accountability report card information agrees to the relevant supporting schedules or other documentation uh you I know our district is is still in the woods because of the economy covid but you know let me say that uh we have made great strides moving away in from the past and into the the future we have made progress you know that we can present to the community fairly that this district is spend ending money properly to the best of its abilities so uh on that note I I want to be you know I'm able to assure this community that we are on the path of fiscal responsibility and yes uh and to give my appreciation to assistant superintendent Shang and business services for for literally uh big digging us out of a serious ditch so

271uh you know on that note thank you very much Madam president thank you trusty fam we're gonna go ahead and go with trusty Chavez and then trusty Beano trusty Chavez um can you hear me yes okay um I I'm kind of like repeating a little bit what he said so I'm looking to address the solutions for the recommendations of necessary internal controls to to ensure the accuracy of the financial reporting what checks and balances need to be implemented is there a better program that the district can Implement to spend the education dollars of the children better um I'm just looking for better fiscal responsibility here um do you recommend something uh sir can I ask him questions and can he answer you Rec can you recommend certain programs or or certain things that we should

272be doing that we that the district isn't doing right now I I don't have any specific I don't have any specific recommendations for improvements um you know there are some findings in the prior year that have had already been uh resolved which are are you know identified as implemented um and in the current fiscal year there are no areas where I felt or our our firm felt um needed to be elevated for an internal control Improvement so I guess if that ansers your question there are always best practices that can be implemented by any District in any part of the state I guess that's what I'm asking for best practices and if so if you can give that list or information to the um to them and see if everything is being followed diligently thank

273you thank you chy Chavis and thank you for those questions because it allowed Mr Charles to repeat what uh good job our Stafford is doing and having been a parent through the times that we weren't here Mr Chang I want to thank you for you know doing your work and obviously with the leadership of Dr Bower but I mean you have gone through a lot being the direct person dealing with a lot of this so I just want to thank you uh for continuing to show up and continuing to um do the work on behalf of our of our district our children our staff thank you again uh trusty Viano yes thank you um couple I have about three questions maybe two because I think one might have might have been addressed already um but

274so I hear that you know it is a very favorable report and and that to repeat everyone's comments comes from the I'm going to use the word competence of of Mr changen and his and his team but you know during the time that I've worked with him I've encountered nothing but competence and and humility when he doesn't know something he you know he'll look into it or he'll get back to us and so I appreciate that um and so Mr R I hope I'm pronouncing that right um are there any particular areas or items that um that kind of stood out that that are different from past years or at least last year to this year or is it across the board or anything you would point out I mean I can't I can't identify

275any any stars if you will that I want to put out on the audit report you know I think our opinions speaks for itself than that it is an unqualified or unmodified opinion so it's a you know that's the the the communication that I can give as the external auditor okay and then um I mean I'll ask the question anyway I think you answered it already are there any identified areas to watch for the maybe there's nothing for this current year but any on the horizon to watch for I don't know if that's a different slant on the previous question um and if you could even address it at all so all right I mean there like I said there's always best best practice improvements that can be made on any districts with respect to

276their internal control structure I don't have anything prepared comments that I can identify as as improvements um for alumrock uh for 2021 and going forward I think you know um you know really as a broad kind of understanding of a going forward position you know you got some funding from from cares act and other support that's going to be one time time um in in the 2021 year and and um you know that's a lot of districts are receiving that similar type of funding um and so being diligent in your use of that that's that's important but that's I would say that's not specific to alumrock that's every District in the state who's and every governmental entity who's receiving these kind of funds is to you know use those um as they need to okay

277and my last thing is um so you know I don't know how long you've been on tonight but but you may have have heard you know we do have a very active community in in these meetings and and certainly online and and that's a good thing um you know and and so I think the sometimes the unfortunate thing is that information on all these different platforms goes out that may or may not be accurate it it certainly is someone's opinion and so they're entitled to those opinions um but I like to to the extent possible use these this space to pre kind of present the official um or you know a the the in the informed information if that actually makes sense so the what I'm asking of you or requesting if it's possible is

278to those in the public those in the community who may um be some of the people who have questions in terms of the financial responsibility of the district and how we are operating from a fiduciary perspective is there any way that you would kind of be able to put into layman's terms just what does your what do your findings indicate um I mean I I think it's pretty clear but if it's helpful to others that may question have questions about our district and and our financial practices is there any way to I mean provide that in in layman's terms I guess is how I would ask it I I guess I would say I I I think I have to revert back to that our audit of report and the opinion that goes along with

279it gives um you know the ultimate result that I'm able to give in you know formal res response um you know like we can talk in more general terms about what kind of improvements or best practices can be made but again or or what what what are kind of highlights of the audit report um in in general terms not just necessarily specific to Rock but you know I can I can only speak to the opinion that we gave in the audit report okay and that opinion I mean I think and that again is an unmodified opinion um so it's basically what we would say is there's no material findings that need to you know the the financial statements are fairly stated again in all material respects so in result of our testing because we did

280not perform one 100% testing was it's not costeffective for any entity to receive a 100% uh testing of their financial information we take an audit involves taking samples of information so in the samples which we believe were representative of the population uh we don't have any issues that we need to report out okay thank you so then my last comment will be thank you very much uh my last comment will just be that um you know I know our district and and many districts always have things that we could continue to approve improve on and certainly I look forward to Mr changen and his team continuing as as you know this car money and all these different Dynamic things coming to our budget the the repurposing of schools and all that but um I think

281it's reports that we get like this it's those results that we see overwhelmingly from parents in our district and students in our district that that are the real Narrative of what's Happening Here and I continue I continue to want to push this out because I I know we see media and social media um comments to the contrary people are entitled to their opinions and there may be some fact in those opinions but I like to see these um these factual reports and data that indicate the reality at least from my perspective of what's occurring in our district and compare that to where we were two three four years ago we're by no means perfect but I think we're going in the right direction thank you tryano uh I see trusty Travis's hand up trusty Chavis

282yeah um I guess when I asked earlier if we could see that list can you also Supply that to the trustees and I look forward to seeing the list of the best practices and one of the question that I have heard in many of the board meetings uh if if our if the books are reconciling or not uh it it seems like the way you presented this uh that it seems okay but then why are we in a deficit and the the public asks me that all the time why are we in a deficit do you have an answer uh I can have uh Mr changen answer the financial information questions that you've asked there I mean with respect to the audit the audit is asking whether the financial statements accurately reflect the actual activ

283that's occurred during the fiscal year so you know that's that's what I mean there's more to it perhaps but the financial information presented in this report uh based on the sampling and the testing that we performed accurately reflects what actually happened so it's not out the the concept of um budgeting and um whether you know youve meet budget is outside the scope of the external Financial audit thank you um with any other trustees have any questions or comments okay so um thank you so much uh Mr Charles for presenting and um uh your uh entire staff I'm sure for being a part of this audit um again thank you to the staff for providing the information um it was beautiful to see especially the slide of like no complaints at all so um that that

284we know that um but it's always nice to as Mr uh veano mentioned to have it out in public in this way um and to assure our community that we're heading in the right direction as a as a district so thank you again um and with that was it do we need to vote on it to accept it or yes yes okay with that uh move approval move to approve by we have a motion yeah I I motion so I move thank you all right let's move to H vote it's it's 10 o'clock so here we go just be patient we're doing great um so we'll just go down the list trusty Bano hi trusty fam hi trusty Chavez hi uh board vice president kto Hi and myself I passes unanimously thank you again um

285and we'll go ahead and move on to the next item uh 603 uh Dr Brower I'm gonna pass it on to uh call Vera Mr Chang welcome back Mr thank you Dr B and Madame President um this is an information item that was requested and the report um is presented or provided in board book um for your review or and the public review um just couple key um highlights that I believe is noteworthy um in terms of the board I mean the the the credit card policies um the limits that has been presented in the policy so has been reduced um per fmats recommendation um except for um the purchasing manager because um that requires a higher limit but for every other um credit card that we have with the districts that has been cut

286in half um and the statement itself um those are reflective um a statement from July through February July 2020 through um February 2021 thank you thank you for that information um it is for information only but um we'll go ahead and open it up to public comment uh Mr monan do we have anybody on for public comment on this item this time we have one person uh Brenda sendas welcome back Miss sendas as soon as you begin speaking the timer will begin um good evening board members um thank you guys for providing this uh president Corina um for making sure that this was on today's U meeting I do have some questions though um over this uh this doesn't equate to the 30,000 that was on figat report um it stated that there was um

287some I guess questionable uh questions about superintendent's 30,000 use of the credit card um I see in the report that you guys submitted it's very confusing because it has several uh I don't know how this works so this is why I'm saying there's several names um on this and I want to make sure that you know it's transparent um this only says like you know spendings and TJ Maxx and stuff like that I don't know if this is District 's or you know going to Jade Garden a lot I'm I'm just asking um how does this work and is there certain vendors that are only uh allowed to be used in these credit cards for example I know some schools have only a Lear a limited amount of vendors that they can go to um

288to purchase right so I don't know with admin level how this works but I do want to see more transparency um on what was purchased uh like for example a Target or TJ Maxx I don't know if that's available but this is very vague and it it's not you know entirely you know I'm not going to go back and forth with this but if there's a way that maybe it's not on board but public records it can be given the receipts of all the purchases um that were given because that was on fake M report and this is State money these are are tax money so these are things that I question as a taxpayer as a resident here um and I won't even make you guys do it through this so if you can

289send it to my email that will be fine thank you thank you uh Mr Manan we have Paul Soto welcome Mr Soto as soon as you begin speaking the timer will begin uh yes uh thank you uh Paul sto lifelong resident of s um i' I'd like to just point out to to the to the group that I've been through the uh a lot of the conversations and a lot of the uh like disconnect that that school district has experienced over the past maybe 40 years you know there there there always just seems to be uh controversy and that controversy always seems to involve money and and and this is just a a fact as a as a as a lifelong resident of of San Jose and so really it's it's it's it's it's the

290community's responsibility to have that level of skepticism um the level of skepticism was actually placed there by people that did not practice um their fiduciary responsibility with respect to the district and its impact on the community and so it it's it's important that the public challenge at any point in time and that the board have a have a certain amount of difference and respect acknowledging that we understand that you are exercising power that we don't and so there's a there's a there's a power Dynamic IM balance the only way that that power Dynamic is balanced and to assure I mean to affirm the fact that you work for us to ensure that we have what it is that is legally uh allocated for us us and if there's something a Miss within that that when

291we question that that that questioning not like be taken personal but the fact that that's our actually our responsibility as Citizens thank you thank you Mr Soo anybody else Mr Moran sorry no further uh uh speakers thank you so much um and we'll go ahead and come back to the trustees any questions comments concerns uh trusty Travis uh yes I want to thank the the two speakers that just spoke um and um I think it's an excellent point that he made that to affirm that the money is being allocated for the citizens correctly um the other speaker asked to um share what the purchases were I have not seen that but uh maybe uh Mr CA and our if if Dr bow allows us to meet uh Dr bow perhaps we can can be shared

292with me and if I can get um uh hard copies of that too please thank you thank you any other trustees questions comments trusty wano just a quick question there if you could answer this um I of curiosity I don't I don't know the answer to this but are the the credit card polic policies and practices um and the implementation of such are they one of the things in in any way shape or form that's included in the audit that was presented to us just a few minutes ago or is it a is it separate from what we go through in the audit yes so um you may recall that Mr Ry U mentioned that they do audit sampling of the transactions that occurred throughout those years so um I'm not sure if any these

293specific transactions that's reported in in this report was pulled but um part of the audit process um that that Crow does is that they do sampling multiple transactions um to determine the allowability use of of of those monies and so the the the thought being that by pulling a sample it's a it's assumed to be a representative sample and when they pull a sample find is um then extrapolated to their to the decision or or it's assumption is made that um the the other transactions are likely to have occurred in the manner of the transactions that were audited and found to be appropriate is that accurate that is correct I'm sorry can you repeat that can you repeat that yes that is correct okay thank you trusty Chavez uh in the past when I have

294looked at the state audits it seems to be a lot more in depth and a lot more thorough and has all the recommendations that the district should Implement uh so I look forward to seeing uh the information I just requested thank you um any other trustees before I make my comments or questions uh vice president yes uh I want to thank the the folks who've uh uh reached out and Express their interest in the finances of the district is exactly what these public meetings are all about and once again I I want to reiterate that I do appreciate folks looking that's the only way in which you can go ahead and keep you know your your government accountable so uh the fact that we're responding doesn't mean that at least in my in my case

295I'm that I'm upset or I do appreciate the fact that folks have reached out and asked for further explanation because that's exactly what needs to be done now with that being said I appreciate the scrutiny that's given to Al Rock we've had significant amount of scrutiny and that's exactly what we we are supposed to do or Public School District I would encourage uh a lot of folks who also have concerns about public money to start reaching out to some of the some of the charter schools uh because I know there's a we we are very open and by Design we go ahead and we have a brown act that we adhere to and provides space I would highly encourage you to also go and uh you know seek with the S same level of some

296of these charter schools that operate with public money they are taking public dollars that come from the state and so I would ask that you support us and going out there and looking and and ra and asking the right questions because a lot of these folks tend to have meetings in obscurity uh very difficult to find when exactly they meet um and uh you know probably abiding by the law but not in the spirit of law and so please also uh I'd encourage you to start looking at uh places like you know voices DCP uh Ace um all these Char schools that operate right here in the east side and so I do appreciate the comments of the folks that I do represent right here within the boundaries of of isan Jose I appreciate you

297reaching out and uh and I encourage you to further scrutinize and go beyond us and also start looking at some of these privately operated organizations that that handle large amounts large sums of of our public tax dollars and uh don't always give us the same amount of u of uh of openness that that we tend to that we have to provide and we gladly do at least in my in my case I'm very glad that we are very open about our finan thank you trusty bar I do see your hand up I see Mr fam and Beano and I also have some comments so well I see you I'm not GNA forget you thank you go ahead Dr bow and we'll go trusty bow go ahead sorry superintendent power I've I'm trying to hang there

298yeah no no superintendent um I want to just H ask Cola to clarify the Fig finding because I think that the the speaker has misunderstood the finding and I want everybody to be very clear about about that and there are receipts for everything that was purchased not only with my credit card but with the other credit cards uh and just so that you know the TJ Maxx purchase was H the little table in um uh maribel's area and the little rug because if we were to go into office spaces and things like that they're super expensive so we're always trying to save uh the rest of the furniture has been repurposed so I just wanted to tell the public that's what that was um we we do our best a lot of the the uses

299were for books for the parents uh over the months um in in the fall so I just for the clarification uh and and yes we do uh have to follow whatever uh vendors the district has approved so so um Mr Chen can you please for the public uh clarify the finding so that there's no confusions about that thank you may I respond uh for president okay yes okay um yes so the the concern that fmat raised um was not um reference to any transaction that was not allowable they raised the concern about the credit limits of those credit cards um and as a result of that we reduce all those limit by half except for the purchasing manager because that requires a higher limit so for example the um purchasing the credit card limit um

300previously for the superintendant was $330,000 we reduced that to 15 um her administrative assistant uh was at 20 reduced that to $10,000 the fiscal director was at 30,000 we reduced that to 15,000 um and the human resource um assistant superintendent uh was at 20 we reduced that to to 10,000 uh the only um one that we don't we did not reduce was the purging man manager uh credit limit and that remains at 30,000 so th those were the concerns that was raised by fmat um it wasn't any concern related to any transaction that was not allowable for usage of those credit cards thank you Mr tang and Miss uh Dr Bower that was important for me that was one of my comments because um it is important that we don't uh put out wrong information

301and then add to that um we just heard a report an audit that said how transparent we are and we get to um listen to the information that's being provided and ensure that we are um stating facts um and not making up things so um thank you for clarifying that Mr changen for some people that weren't understanding that um it's important and um that was gonna be my question we'll go to Mr fam Beano and then Chavez uh thank you board president uh again you know this shows our commitment to transparency um members of the community ask for this to be placed on this month's agenda and bada bing bada boom here we are pres presenting uh basically credit card statements for three quarters of this Academic Year uh you know uh having been on

302the bond committee yes I am familiar with the fmat and I do want to confirm assistant superintendent Chang's remarks that yes no one no one has spent $330,000 at least in the FM audits that I've seen no one in this district has spent $30,000 on a district credit card uh you know they were credit limits that were deemed too that were deemed too high for certain positions and I'm glad that this district has taken action to reduce those credit limits uh you know and secondly to Echo bo uh the sentiments of the board vice president a I agree uh that's one of the beauties of a democratically run School District we are accountable to the residence of alam Rock and we you know every day work to be responsive to the needs of our residents

303res and on that note uh you know there are charters schools in our region who don't measure up to Snuff one of which was a recently shuttered Ace charter school because they were not producing the academic results with the tax dollars that they have diverted from our district and so you know um helping our community out is all you know should include uh putting putting a spotlight on the of uh mismanagement of some of our local charter schools which have resorted to uh opaque practices that uh try to get rid of transparency in uh financial affairs and as well as academic performance so you know I I want to I want to stress that improving Alam Rocka is a team effort by all of us in this community and we should work together to to

304hold anyone who educates Alam Rock children thank you very much I'm sorry for interrupting but it's going to be 10:30 I know Ban's next but I just wanted to put that out there thanks thank you trusty Travis uh should we extend the meeting now I mean we're gonna extend it anyway so any I'll make a motion to extend till midnight second okay uh we'll go ahead and do we get to open it to public comment or no just vote on it okay uh tryano hi JY Chavez hi Jessy fam Hi H board vice president GTO hi and myself I um so going back okay to this item trano okay um I I also I just wanted to Echo um trusty Kino's statements about I I also welcome the comments of the community and and and

305I am informed by those comments I may not always agree with those comments but but if I would hope that if a person were to listen they would hear some of the comments and questions that we get reflected in our questions to presenters that we may have or to our staff and so in that way when um you know I know the term deference to to the community's concerns was brought up I think that demonstrates that and I think it's important um I I'm not offended in any way or or you know have personal feelings about questions that are asked or comments that are made that's the right of the public to make those comments like I said I may not agree but I respect that right um but I think when we respond in

306terms of asking questions of the board or clarifying or confirming at least for me personally one of the primary reasons why I do that is because it's not because you know to try to prove someone wrong or anything like that it's to demonstrate the reality the truth because that truth that reality has an impact on you know things like our credit rating if they're looking at the stability of our district and and our governance and things like that it has an impact on the public perception it has an impact on media it has an impact on social media parents need the accurate information and so and if the information is is the question that was asked if we don't have an answer for that or response then we as a board have the obligation to

307to either speak one-on-one with the superintendent which I know I have and I know specifically other board members have done that and things like that may happen in close session but I think it is I I thank you know um one of the public speakers for bringing up that point because it's important to understand why you know the responses from the dis from board members sometimes happen and and how we respond and I just wanted to assure the public that I I welcome I want your comments oh the other last thing I wanted to say also is that just because we're sitting in these seats we I'm still in alrock District I'm still a taxpayer in alen Rock and so I'm also concerned whether it's East Side Union or alen rock or whatever District that

308I'm paying my tax dollars to I'm concerned about that too so my sitting here does not mean that I'm still not con have some of the same concerns that you have so I just wanted to point that out as well thank you thank you trusty Travis uh yes um on page 24 of the fmat report it said that it questioned if it was used on the district so they they were questioning how come it was you know it was so high and if you go to the page 24 on the fmat report you'll see more in depth so uh yeah that's it thank you trusty chavz are you talking about the 30,000 yeah can you elaborate okay if you go to page 24 um then on the figat report you can see it and I

309think think maybe we should we could address this in the budget committee meeting can trusty can you elaborate what does it say on page 24 do you have it right in front of you would you be able to to challenge what it says I'd like to know if there's like I said we can we can talk further because I would like to first ask T after our budget committee but you like you can go to page 24 on the report as well thank you can you show it to us one second let me let me come back here um because I am also confused trusty Chavez so I just want to clarify because is this a public meeting and everything we say is important so you're saying that on page 24 of the fmac report

310there's what information again can you repeat the information that's on there what they said and it's blurry and I don't want to I don't want to repeat it in any way shape or form or miss a word so I encourage everybody to go to page 24 to get it in writing from them thank you okay trusty Chavis I'm still confused though we're talking about this credit card um report what does that have to do with this I just want to make sure that I'm understanding fiscal responsibility thank you okay I I'm still confused maybe if I clarify are you talking about the 30,000 still I'm talking about the comments that were made about the fmat report that Mr Paul sto and Mr Bren Miss Brenda s De has were referring to and so like I

311said that is in black and white and people can look it up and I think it would be best if Mr CA answer questions offline thank you thank you trust Chavez it's very important that we hold these meetings in public as uh you mentioned the two uh members of of the public who are asking questions and should hear the answers um I think Mr Chang already answered those questions so it's it's uh important that we make sure that if we're going to present anything that we present the correct information so I just want to clarify again the 30,000 that Brenda has questioned earlier because you mentioned her name um it was clarified that that was the amount that the credit card had at the time so it wasn't a spending it was the amount that

312the credit credit card had to be able to spend so because of that it was lowered to 15,000 so I want to make sure that our public understands that we are following the fmac report and the recommendations that they made to lower those so we lowered it to 15,000 thank you staff I just want to make sure that we highlight that um because I don't I don't want the uh public leaving with any misunderstandings based on this conversation uh Trust I think you wanted to say something I mean just because um trusty Chavez was reluctant to identify where she was I'm on page 24 of the fmat report and I'm I'm not seeing it so I'm I also am confused about what she's referring to but I'm satisfied with um your comments that you just

313previously made president so I I see no need for me to at this time look any further because I don't see it here on page 24 okay page 23 sorry I scrolled it page 23 clarify it later because I think we should move on because I don't want I can't move on this is the item that you're then don't move on but I I'm not the one who's the accountant that needs to answer those so if you if Mr Kinto or you or Beano need that answer I am not the CBO and if you guys are F think there's a question yet I want is there question that you asked no I'm referring to the question that Mr kto asked for me to to read it out so I I don't think that that's my

314job to do it so if everybody wants to read it they can read it on their own time and that's it thank you I think it's my job to provide transparency to the public and this conversation obviously has has you know gone to where it's gone so I would be interested and not only to tr to provide transparency if there's something to be concerned about that we're not addressing then I want if you're pointing something out that I need to be concerned about trusty Chavez I want to know so again I'm looking now at page 23 and I don't if you could give me the paragraph you don't have to read it out I I'm more than comfortable to read it out so that the public can know what we're talking about um but I

315don't I can't identify it here on my own just kind of scrolling through as I'm talking so if you is it on the top the bottom what paragraph is it on I like I said before four I need to ask Mr COA more questions offline to get clarity for myself I'm not going to interpret something that I didn't write myself so until I go more in depth see exactly what those receipts and everything said then I can make a better judgment but until then I am asking the question can I see those receipts in the email that's it that's all I ask for if somebody else needs clarification let that person get clarification from somebody else that is not my job my job is to look into anything that I think that needs to be

316more transparent that's it thank you thank you if I can take back I can take back the meeting here can I final statement uh give me one second okay one second uh trusty Chavez I think you went back to an earlier request which is great we're all here to make requests to ask of our boards so you ask for receipts that's a clear request now the other stuff of page 2423 is not very clear so I'm with trano and going back to those pages and ensuring that the facts are provided and so when you're able to meet with Mr changen and get the answers that you need um please bring them back to us because if there's anything that we need to be concerned about as trusty veano mentioned please bring them back to us

317um other than that let's make sure that we don't bring up anything to the public that we're not too sure about so um thank you for looking into that exactly thank you that's my point so before we go to you I'll go ahead and go to trusty wano trusty fam and then we'll come back to you trusty chavz thank you for those com thank you for those com I'm just what I was goingon to just say is that you know I respect trusty Chavez's decision if she you know she brings something up and if she's not comfortable at this time explaining it or being clarifying it or whatever I respect that that's that's that's your prerogative and I have no problem with that all I'm going to say is that I'm going to then if

318that's the case I'm going to assume that you were just mistaken there's nothing that I see and I'm completely open to being corrected but in this moment looking at it I see nothing on page 23 or 24 that indicates those claims so I'm just going to assume that it was an honest mistake by yourself trusty Chavez on this one you may maybe it's just a different page or something but any reference that's been made tonight I'm going to assume given all that it's just a mistake and so I'm not going to look any further on this at this time thank you trust we'll go ahead and go to trusty family and we'll come back to you trusty Chavez okay uh you know I too am looking at Pages 23 and 24 of the fake matat

319of the most recent fmat audit and uh again and since this is in public I will say you know bear with me I will read it says quote account Town stable District staff reported that Cal card limits are as follows superintendent 30,000 senior executive assistant since superintendent's office 20,000 director of fiscal Services 25,000 procurement manager 30,000 assistant superintendent HR 10,000 uh I really you know if we're going to site specific pages in an audit you know it's very important to get it right uh as I mentioned earlier uh I have not seen any charges on a credit card of this District in the amount of $30,000 so you know I want to caution my colleague trusty Chavez at you know before before making statements like the this we we need to be careful and do

320our homework uh this is you know just as we're making progress as cited in item 6.02 you know let us not be uh driving around in circles looking for references we can't find um at the same time I want to thank her for for bringing more scrutiny to the items purchased by the credit card I think that that's certainly a necessary question that should be asked and I thank her for it but on but again on the issue of uh citing audit findings uh please make sure to do your homework before you site something that none of us can find thank you very much Madam president thank you trusty fam trusty Travis okay like I had said I hadn't read the whole report I started reading some of it I didn't memorize memorize it I

321did not write the report but it's better to get a better understanding and ask the CBO those questions before I do it online and that's why I hesitated to say it because if I got the page that I read it said that they thought it was high and so the district lowered it why did they lower it and how did they lower it and how did they come up with that figure so those are questions that I will be asking Mr CA offline thank you thank you trusty Chavez and I think you were repeating exactly the same thing earlier so we'll go ahead and move on um TR um superintendent Bower something you want to say before we move on here the answers to trusty Chavez questions are at the very beginning of the report

322just so that the public knows that if they go to item number uh 603 all the questions are answered for the public uh as a in as a cover to the report thank you thank you all right we'll go ahead and move on I'm seeing no other comments or questions um to 701 approved resolution of uh Asian-American and Pacific Islander Heritage Month move to approve to and second by vice president GTO um at this time do we want to go to it and um is there somebody who's gonna present on it or we can just go to it and um read it out loud or not okay um so we'll go ahead and uh motion by vice president kto and moved to approve by trusty fam uh Asian-American and Pacific Islander Heritage M resolution um

323I'll go ahead and read it out loud whereas the state of California is home to more than 700,000 students of Asian and Pacific Islander descent kindergarten through grade 12 whereas these students reflect the great diversity of culture and Heritage of many countries of Asia and the Pacific Islands whereas despite the hardships and barriers of past and people of Asia and Pacific Islands who came to this country and their descendants have made substantial contributions to California's economic growth and development and have woven clear distinct threads into the state social fabric whereas the alrock school district and the California State Board of Education recognized in policy statement on Multicultural education that each student needs an opportunity to understand the common Humanity underlying all people to develop pride in his or her own identity and Heritage and to

324understand respect and accept the identity and Heritage of others whereas a historic history social science framework for California Public Schools kindergarten through grade 12 states that the history curriculum of community state region nation and world must reflect the experiences of men and women and of different racial religious and ethnic groups and must be integrated at every level and whereas Asian-American and Pacific Islander heritage month is celebrated annually at the local state and National levels now therefore be it resolved that The alen Rock Union School District joins with the California State Board of Education in proclaiming the month of May 2021 as Asian-American and Pacific Islander heritage month and encourages all educational communities to commemorate this occasion with appropriate instructional activities and be it further past before we get there um go ahead and open it

325up for public comment um Mr Moran do we have any one on this item wishing to speak to the board yes we do have uh Paul sto welcome back Mr sto as soon as you begin speaking the timer will begin uh yes thank you and and thank you for crafting that uh that document that that is just uh considering that the Vietnamese community of all the cities in the world and 1973 they found a safe haven here in San Jose this is the largest Vietnamese Community outside of Vietnam in the world okay the CH throughout my research I've been discovering the true history of California and if it I I I would I would hope that there could be some type of of educational piece that you could link to that to really give people

326a sense and an understanding understanding of how we got to where we are today because it started with lelan Stanford and Peter Bernett who are the two co-authors of the Chinese exclusionary act along with judge Lawrence Archer who is the who who was the head of uh he was a lawyer for the railroads at that time and so did that Chinese Exclusion because Chinese uh uh or Asian uh uh Asian racist ideologies is not endemic to California it's it's just not it's something that was introduced through State Legislature and policy and so see that's the piece where like our minds have been conditioned to perceive reality a certain way because of the brainwashing that goes on in these schools and that's why I participate in school board meetings as well because the crime against humanity

327starts in those School District districts because of the conditioning and the lies and the fairy tales and the myths that we have told our children as accepted reality and truth and in fact it's it's it's it couldn't be further from that so I applaud you uh all for crafting a document I would just ask that something additional in terms of references to that history be given as well thank you thank you um anybody else Mr one on further comments thank you um and I just want to clarify that um if you uh look at our board book um there are links attached um and different lesson plans informational resources teaching resources videos um I mean just a whole list so um thank you staff for crafting this and putting this together uh for our district

328um I see trusty varano's hand we can yeah I was just going to mention what you just said right now and also you know along with all of our public commenters I think Mr sto brings a you know as he participates in our meetings an interesting perspective often times and so I appreciate that and and I appreciate his wanting to connect the you know put the put it into some action and so I thank you for pointing that out trustee uh president era and also I'll just add on to that that that's why we're all so excited about you know the ethnic studies work that we're you know that we've already approved and we're it's a slower process than maybe we want but it's needed to be intentional about that process and so that the

329racial Equity committee I think we're moving in that direction but but I appreciate the sentiment of wanting to put action to these things so that we're not just you know giving um you know what's the word tongue or we're not just talking about it we're actually doing something providing that so thank you for that thank you trustan I'm seeing no other hands up uh we'll go ahead and move on to V on this item I'll go ahead and um go down the list trusty veano hi trusty fam hi trusty Chavez hi vice president Kinto hi and myself I passes unanimously thank you um item 702 move to approve move to by second by trusty fam chave oh Chavez okay uh Chavez um with that uh we go ahead and move on move to that item

330where is right here are you still on 72 you're still on 702 correct S I am on 702 correct do you want to speak on that item yes I do okay please go for it all right uh so as a broken record uh every year I want to encourage folks to um take a look at David Hayes btia s American tradition so you can go ahead and be educated as to the um Real History of s m here in the United States and why it's celebrated such a larger scale here in the United States as opposed to Mexico where the original battle took place uh it's important to recognize um the things that were taking place at that time but folks uh here out of some say that were going out there to fight both

331the French in pbla down in Mexico and uh they were actually going out to fight the Confederacy uh out uh in through Arizona into New Mexico and they were being picked up right here by our own a hero a local hero born right here in s Jose um and so um he came from the P family uh very very wellknown family of californos uh he was here uh went ahead and led a u a a a group of uh Latino primarily Cavalry that went ahead and pushed back against uh the the Confederacy and so just want to make sure that people un you know that there's an opportunity to discuss the roots of squo here in the United States as outlined uh very well by Dr David hay balista and S my American tradition and

332then we also take the opportunity to acknowledge local Hometown Heroes like um you know I'm glad to see that Thomas Fallon's being removed off of downtown um but there's no acknowledgement of people like uh people that went out there and uh and worked hard to push back against these these Southerners that were attempting to perpetuate slavery all over the place and um and so little little regard is given to somebody who went out there gave a lot he had a fight for his pension that he was well deserved I'm not sure if you ever actually got it died a very very uh humble person out in Alam but he was born right here in San Jose uh cap then Captain J thank you so much for that detailed information um proclaiming May 3rd and May

3337th as the Sinco de Mayo week um so I will leave it at that very detailed information I um won't read through it but you're more than welcome to read through our board book um and we'll go ahead and open it up for public comment Mr Moran do we have anybody wishing to address the board yes we do we have Brenda sendas welcome Miss sendas as soon as you begin speaking the timer will begin good evenings um I read this resolution and I have a couple things that I question of words that were used here um I know that Hispanic is used in many forms for me Hispanic translates to espano descendants of Spanish Sellers and I don't identify myself with that name um so I just question this use of word for this resolution

334as a Latina I don't call myself Hispanic um that was a name given to us by the Spaniard when they did census and so I just wanted to say that today that and recognize that I am not of Hispanic descendency and uh I don't like that word being used in this resolution thank you thank you um anybody else Mr Manan yes we have Paul sto welcome back Mr sto as soon as you begin speaking the timer will be uh yes thank you uh once again uh thank you for the efforts that went into crafting a uh a uh a position on Sink of the m and and the the celebration of it the celebration of it was also a part of San Jose history where the micos raised the Mexican flag at the at the

335new Aladin mines when they were uh when they were uh working in the Mercury mines and this was the way that they were establishing and maintaining that connection because the Mexican is the only race of people in the world that are considered immigrants in the land of their origin there is no other psychology that could fit that it is only the Mexican and so that that's why it's important in terms of verbiage I agree with what Brenda had stated is that there there there is this there there's a psychological dis disconnect you have bisas you have chos you have mexicos you have Latinos you have Hispanics you know there's a lot of these ways in which we I identify with what has happened here in California and so I think there needs to be at

336least uh some some degree of appreciation for that you know I myself am a Chu you know and and that's how I identify you know because that's that's what I believe I don't speak Spanish because of the abuses that went on in elmrock and elmrock and and and other school districts that's why there's an affinity a particular affinity for this one because that is where the crime against humanity and the cultural uh genocide that my mother experienced and passed down to me and I don't speak Spanish now because of it and so these are these are conversations and things that I do in my work to really Center these perspectives within the public forums so that the city of San Jose can start accepting some type of responsibility for everything that's happened in the city

337thank you Mr s uh trustee um actually um Mr Moran anybody else from the public no further speakers thank you uh going to the trustees I see trusty witho with your hand up uh go ahead yes um thank you I appreciate those public comments that's actually I I motioned this for the purposes of the discussion because I did want to uh bring this up and I think this is something that I brought up last year and or the year before and um I I so the one of the lines the word Hispanic is used specifically tied to a a data point or or a percentage so I would assume that and I'm assuming also that trusty kto is the one who brought this so I guess my questions or comments would be kind of directed

338towards him so I assume that that one that is specific to 37% of of the population if that's what the how the data was represented I don't know that um you know we could take the liberty of of modifying that however I I too um think that that the word Hispanic does not necessarily capture the sentiment of of the rest of the document and and what's really behind it and the whole um everything about s De and and all that stuff and so I I was going to point out or or ask if we could use a different term or or or how my colleagues felt about changing the term where it's not specifically tied to that data point because I I don't know that we could change that so I guess maybe that's directed

339towards trusty ketto if you're the one who brought this resolution and hey you know it's it's the body's resolution at this point and so if the majority of the body feels um that more comfortable with the term Latino you're right um the the did comes from the Census the census uses the term Hispanic um and so to go ahead and try to parse it out or use it differently would be would not be accurate but with regard to the rest I would have no issues um changing it to something that the body feels more comfortable with um I would I would ALS I I would suggest though that I would remind folks that um it was Latinos that were fighting Hispanics we call ourselves Latinos for most part uh having been to the east coast

340they're very comfortable with different terms and people in New Mexico and other places use the term Hispanic um but here if we're more comfortable I go with would would the term Mexican or mesiso work in either of those hey whatever the body goes with I'm fine I'll throw those out there I'm comfortable with M think that thank you um and I'm comfortable with either or I was going to say Mexican because we are talking about Mexico we are talking about Mexican so I mean I was just to make sure that it flowed um but I'm comfortable with MSO as well so the only the only issue would be that if you actually um take a look at he Batista's book you'll see that there were a bunch of different Latinos that actually involved in the

341actions around s Mayo um and so you had people who were chilenos actually going out there and getting into the action um so um it's it's kind of fascinating you see have this Mexican Center type thing but it has people who immigrated because of the gold rush and now they're getting into the you know fighting fighting against imperialism fighting against old foreign Concepts like slavery and nasty stuff like that you have people from all over the place getting into the action so pretty exciting stuff put in a plug for the book again we'll take your class um well so any suggestions I I heard you trusty Bano mentioned I I'll just modify him to Mex I'll modify M to Mexican I think you're right at least flows um I think that's maybe the best we

342can do but I know trusty Chavis has a comment so um I guess I was gonna go with Mexicans as well but like uh like trusty kto says he always likes to use the word folks but are we just going to limit it to Mexicans and folks or or just Mexicans or or are you going to state the different um nationalities that were there are you going to ignore the other ones that were there as well because if you just put one and don't recognize the other then what I I'm hearing you say you so I'm not sure if you're asking somebody in particular but I think right now the uh recommendation is Mexicans are you recommending something else trusty Travis um so trusty kto just mentioned that there was Chileans there and there was

343also others that were in laaya like they say in the battle so are you gonna just limit it to Mexicans or are you also gonna make it plural and add the other ones right and that's a discussion we're having so right now um the recommendation by trano is to put Mexicans are you recommending that we do something else use another word term Mexicans and then list I mean don't you want to be more correct in in in the resolution if there the other nationalities were there wouldn't it be best to recognize everybody and not exclude anybody uh I trust yeah I mean I appreciate that perspective I just think that to not take too much time on this if we if you read through the specific couple of instances where Hispanic is used I think

344using Mexican is fine and it doesn't specifically exclude anyone is just speaking to the Mexican um population in that statement so it's not I don't see it as exclusionary of the contributions of the other groups I just I think that it's it's well within reason and appropriate to to use Mexican in terms of Hispanic instead of Hispanic um in those couple of instances and I I don't feel that that is explicitly exclusionary to the other groups the way it's written okay and I do see it and I'm just gonna highlight itano so that uh hopefully um marel Can reflect it it's the one to third whereas correct where it says many persons of Hispanic ancestries changing that to Mexican ancestry the first one and then the second one would be on the fourth whereas and

345then where it states the Customs traditions and national holidays of Mexico are part of the culture of people whose ancestry is Mexican is that correct and is that it in regards to changing Hispanic to Mexican yes okay um so uh I'll go ahead and uh I will support that um so with that if I don't see any other questions or comments we'll go ahead and take it to a vote uh trusty Viano I trusty fam hi trusty Chavez hi vice president Kinto I and myself I thank you now moving on to the next item 703 uh there was no any motion uh for purposes of discussion I motion to um I think saying that there was motion the past one I thought there was but was a motion motion and second yeah there was a

346motion I think come back on come back so then trus hanano made the motion and trusty Chavez second it correct yes right and you got the edits right yes I was writing them down in the third and the fourth paragraph perfect thank you um we'll go ahead and move on to 703 uh resolution proclaiming make May 3rd through 7th as a national teacher appreciation week motion to approve motion to approve by trusty Chavez second second by trusty fam um I'll go ahead and read this one out loud um unless anybody else wants to or brought it Forward okay uh whereas education is the most vital activity we as a society undertake to ensure the well-being of the nation and whereas education is in large measure the result of the talent and commitment of teachers and

347their ability to inspire encourage and Enlighten and whereas teaching is a profession characterized by skill knowledge discipline tenacity and creativity in the delivery of instruction and whereas teachers are a source of caring concern counseling empathy warmth and love and deserve recognition and gratitude for their invaluable work they do and whereas teachers at the elmrock Union School District in particular educate and motivate students who have not succeeded in other educational settings or have special needs require unique skills and compassion and whereas teachers at the Alam Mark Union School District have made a crucial difference in the lives of students and our true Champions for Children schools and community and before we read the rest um we will go ahead and open it up for a public comment at this time Mr Moran yes we have two

348speakers uh first speaker is Paul sto welcome back Mr Mr salta as soon as you begin speaking the timer will begin um yes thank you for uh submitting that um outside of the home when when a kid is like starting to go out into the world and discover the world the the most significant relationship that that child's going to have is with their teacher in elementary school you know every child will take with them the affinity for the time and the energy and the effort that one particular teacher paid to them my mother despite being treated traumatically and humiliated in San Jose Unified School District for speaking Spanish went on to become a teacher in the same school district by which she experienced that now all of a sudden that which they tried to silence

349in her was now her asset instead of her shame and humiliation and so when all when when when a lot of the pisas started uh influx in in during the 1980s my mother was there to teach them she was there to to to to to to nurture them and and to ensure because she understood what it was like to speak Spanish and that be your only language and so now she became an asset to the San Unified School District and so this is this is the Legacy that I come from and these are the reasons why I'm at these meetings these are the reasons why I can rute what I can of that history so that future um Generations will know and understand what people had were challenged with within the context of the of

350the school districts because that is where these crimes happened that's where it started and so um I applaud your efforts for acknowledging the teacher I will never forget mine I had one teacher in the fifth grade and the sixth grade she pulled me in on both both uh grades just to specifically teach me and everything that I know now in terms of in terms of uh principles I learned from her thank you thank you Mr Moran anyone else yes next speaker is Brenda sendas welcome back missas as soon as you begin speaking the timer will be hi um I want to thank you guys for putting this I think that our teachers um deserve this and more I do um want to thank a couple teachers with this resolution I think that our teachers went

351through a crazy roller coaster this year and this week and I think that five days is not enough I think we should do a whole month if you guys don't mind um my suggestion is to do national teacher appreciation month I think that everything that our teachers have done and and sacrificed for the education of our kids deserves a whole month my my son's teacher Miss Lea I really want to thank her um for her consistency in her class and creativity with our younger kids um my older son's teachers at Joseph George I don't know them all by name but I do know one teacher he does talk a lot about and loves going to his classroom and that's Mr paganelli um I my son's very um distracted and this is the one teacher he

352wakes up early in the morning and he's there and attentive and does his work and it takes great teachers we have awesome teachers here in elmrock we have Miss eler who's RSP teacher she comes every day with love and finding Solutions on how to work with our children um there's so many teachers Miss hasband um you know Mr Michelle that was my son's fifth grade teacher I do want to recognize him because he opened his arm to my son and looked at him in a clean slate um and and got to know him he wanted to know my son and I think that for teachers to be this way and opened you know a month I would please ask you guys to dedicate I know that maybe we've always done a week but it's been

353a a crazy year and I think that a month would be something that maybe the district can do thank you um Mr Moran do we have anybody else no further speakers thank you I'll bring it back to the trustees anyone uh truste Travis yeah I don't see if that's okay with you guys to redo the thing for a month because yeah the teachers have done a lot and I and we really appreciate them not just once one week out of the year um that's it thank you thank you uh trusty kto did you have your hand up uh yeah I just want to speak to the to the resolution and say um that very very much appreciate uh our teachers and um you know there's memories that we have throughout the course of many people

354have that one teacher but I have a significant number of teachers that throughout the course of my education were very very impactful at different stages some of them were in elementary school um you know so some teachers were pretty rough you I you know I had uh I like to say it straight up I had the best of educ ation here in alrock and then I had some one teacher in particular was a an individual who should not got into the profession but that's obviously a conversation for another for another time um but the vast majority of the teachers I had were amazing great individuals that went in for uh the right reasons and intended to go ahead and make uh the world a better place and so very very much appreciative of the folks

355that that I that I had the the opportunity to learn from uh like I said Elementary School we got some caring folks that went out of their way to really really uh develop that that that Bas that that base for for for learning uh and then moving on through up until High School where you had folks who were doing nothing but demanding that you focused on getting to college and doing that stuff like that so individuals that took time out of their own out of their own life to to go out there and and help you and encourage you whether it was taking you to see speakers or going out to different events that kind of expose you to stuff other than what I knew which was just my neighborhood so thank you to all

356those who uh helped me in my educational thank you trusty fam yes I I do want to speak in support of uh the resolution um but you know put it simply teachers change lives uh teachers introduce children to to The Wider world and the skills needed to navigate The Wider world but not only that in in in recent years a lot more has been demanded of our teachers um sometimes uh in part part-time social worker part-time child psychologists uh supplementing the gaps that families can't fill whether it's buying classroom supplies out of their own pocket or providing providing students with a a safe place to be after school and you in this I know this resolution doesn't speak to everything that teachers do but I I certainly believe that uh we should and we ought

357to honor uh the people who staff our classrooms on a daily basis so and so I urge my colleagues a yes vote on the resolution thank you thank you Mr Fram trusty Chavis So when you say that we should appreciate them uh I heard from the last two speakers does that mean appreciate them for a month or for a week um point of clarification uh so uh are you moving to moving to amend the resolution to say to replace the term week with month is that yes I'm hearing I'm hearing trusty Chavez saying yes she wants to amend that to a month okay uh I would be in support of that so I I second the amendment okay um truste Beano I I think that you know if that amendment is is if it's passed

358with that amendment I think then we would need to change language in the amendment because it specifically says that we joined the governor legislature of California and designated May 3rd through 7 2021 as national teacher appreciation week so um you know that whole oh stricken or struck what and also the question would just be what would be the difference other than changing week to month changing that word is there any difference in what would occur during the month versus the week uh and I see uh vice president Gino's hand up but I know that Verano has some questions was that just in general Verano or was that to Bow just in general okay it would be whoever um either trusty Chavez or trusty fam who um put forth or agreed to amend the motion I

359think I put forth the and then and then M said to uh amend it I second I second from minut okay so I I guess I made the motion yes so I guess the question is um do you also want to take out that statement then because so we don't want to let's see where's it at so we need to remove a lot of the the therefore resolved can I speak to the to the motion that was made that's what I want to speak to go ahead vice president GTO through this resolution we're joining a a wider and broader group uh Statewide and so we're not the only ones passing this resolution we're joining the efforts of everybody who's been sent out the resolution throughout the state of California so to just randomly at a

360whim change it to a month um we're going to go ahead and remove that that that broader bigger effort that's the Statewide effort uh furthermore this resolution's already been reviewed by Council um to go ahead and read uh properly and to be conformed with law or you know whatever uh and so the idea here is that I would encourage us to resist changing this on a whim and in the future come back with a um a month-long uh recognition uh so that we don't go ahead and do away with the the efforts that are taking place Statewide this isn't just us well if that yes if that's the case I'm happy to with you know I think War I guess it's 11:14 PM so there's a little bit of brain fog here so uh I

361think I'd be happy to withdraw it and take it as is so that we we are in sync with the governor and the legislature and then for future purposes we could do we could do a national teacher appreciation month for next year or at a month of the board thank you trusty fam I see trusty Chavez's hand up and then I'll say something and then we'll take it to a vote go ahead trusty Chavez can we leave that kind of those words like that but put in addition in Alam Rock we will be doing it for a month that way we're not changing the position that we have with the state but we're doing it for longer than the state is doing it is that possible so I two things I heard trusty fam take

362back the month and now I'm hearing trusty Chavez add another amendment just fam are you in agreement with that Amendment if it's just solely just to add that phrase and if it doesn't change the rest then yes I I will go ahead and second that thank you so what is that phrase truste again Chavez I want to make sure so the way it so the way it works like that you know how they say that the state is going to be doing it one week and then put a comma and that in addition in Alam rock that we will be uh recognizing them for the month or in addition or excess or however you want to put it that works but we're going to do this as well you know extended to the month can

363that be done um superintendent yeah just it's kind of goes back to trusty Kino's point because you're saying just whatever and we can't do that so right now we there get the exact words right because that's what you're going to approve we cannot just come up with any other language that the board does not approve okay so I think that the prudent thing to do is to bring bring a monthlong resolution for alumrock that is not a problem at all that that reads only for alum roog that says in Alum roog we celebrate and you pick the month you can say may is the you know is the month of the teacher or um September whatever the board can do any thing they want right uh if you want to add this at this moment

364into the resolution we have to have the exact words that you want to approve because we cannot change it so we cannot word Smith we cannot edit we cannot do any of that right now yeah thank you so much Dr B so I I'll withdraw the SEC I'll withdraw the SEC so I I think you had already with or or you had accepted now you withdraw it okay so let's go back to the original leave as is um if there's no other comments chavz I don't know if your hand has just been up or there's something else you want to say before you say um I want to say my comments um I agree you know teachers are amazing whether it's a week or a year or the entire Century like our teachers are you

365know sometimes they're more than parents are um for for our children so um for me it doesn't matter if it says you know one day one week one year I mean teachers be um appreciated every day uh so with that we can get to the uh vote soon as possible because we have a lot of items before close session and we have very important things to discuss in close session as well so we can be short and sweet trusty Chavez and trano I I know we're limited on time so I guess we could um approve this one and then bring the other one back next month at the next board meeting thank you awesome okay do I get a second no I mean I'll just I wasn't going to be supportive of the the the

366modified Amendment but I'm supportive of it as it's written tonight and I'll have I have a comment on a different item that's related but that's it for now so I support as written thank you if there's no other comments or questions we'll go ahead and take it to the vote uh trusty Bano hi trusty fam hi trusty Chavez hi vice president Kinto hi and myself I pass it unanimously um go ahead and U moving on to 704 Dr bar anything in particular you want to report on on this item Just for information only okay thank you um no this is approved trusty is there is it on for approval sorry yeah it's on for approval okay we're on for on 704 approve a quarterly report um second BYO all right um we'll go ahead and

367open it up for public comment at this time or any particular presentation or anything Dr Bower before no uh Mr monan do we have anybody from the public wishing to address the board on this item we have none thank you um we'll come back to the trustees any questions comments on this item vote say it again let's vote let's vote all right let's vote so trusty I trusty fam I trusty Chavez I uh vice president kto I and myself I passes unanimously item 801 information only anything in particular M uh Dr bow okay um any questions from the board on this item seeing none we'll go ahead and okay um we'll go ahead and open it up for public comment at this time uh Mr Moran any public anybody from the public wishing to address

368the board there none thank you so much with that um any questions comments if I see none we'll move on to item 802 move approval of 802 second second second by trusty fam um classified School Employees week whereas classified School Employees provide valuable services to the schools and students of the elar Comm Elementary School District and whereas classified School Employees contribute to the establishment and promotion of a positive instructional environment and whereas classified School Employees serve a vital role in providing for the welfare and safety of the elmrock Union Elementary School District students and whereas classified School Employees employed by Rock Elementary School District strive for excellence in all areas relative to the educational Community um and before I read the next part or before we go into the next part uh anyone from the

369public wishing to address a board Mr Moran yes we do we have Brenda sendas welcome back Miss sendas as soon as you begin speaking the timer will begin hi I just want to thank you guys for this resolution once again I believe that classified have been doing a lot of work they were one of the first group of uh employees to come back to our district right um and they've been there almost the whole year uh serving not only our students but our parents and um they've been putting their health at risk from the beginning and they never complained they did it without hesitation and I think we've seen it with with our our cafeteria ladies and our custodians how much they've done in these schools and they continue to do and these are the

370group of employees that are um usually um the most ignored at times because we don't know the value of them um they might not be you know full-time a lot of them but some of them are and those that are you know they are the friends of these kids they are are the smiles to these kids and they are the ones that are the ones that our kids trust the most um just want to thank them all thank all our lunch ladies thank all our nurses uh peras everyone that has been doing an excellent job this year I think they've been above and beyond a lot of them and they don't ask for recognition most of the time they do it because they love their job just like our teachers and the most of them

371live around this area they're are elmrock community community members that either walk to work or you know go to work on a ride and most of these employees um really truly love our kids a lot of them I'm G to say the majority of them and are always ready to work so thank you so much for this resolution and again I suggest a month if you guys can do that as well for them um maybe not today maybe on the month of June or um next year whatever you guys find easier to do thank you thank you Miss has anyone else Mr on yes we have Sharon welcome Sharon as soon as you begin speaking the timer will begin um good evening um can you hear me yes yes oh good okay thank you um

372on this resolution um you know I thank you for putting it on the board and putting them into the board meeting and I just wanted to to say something um the classified employees week is set up by our state Association it is always the third week of the F third full week in May um we can't alter the week um if the district wants to recognize the classified for a full month that would be fine but our actual week is set up by our state Association and um I do know that for the most part all of our managers do appreciate and celebrate their classified um staff all year long and um this is just a special recognition week where we celebrate them a little outside of the day-today job and Miss Zen house is

373correct most of our um members have been back to work and they' pushed forward through all of the um trials and tribulations and for that we do thank them and we do thank you the board and Dr Bower for showing your appreciation thank you thank you Mr Moran anyone else no other uh speakers thank you we move to the trustees truste Chavez I see your hand up uh yes um I was going to also suggest that what we were thinking of doing for the teachers that if we could also uh do that for the classified because we appreciate them just as much thank you great I look forward to um seeing uh that um I'm assuming that you'll bring that in the future to do a month long I agree um and so this one

374as you mentioned will leave as is like as a teacher one um vice president kto and really uh uh I'm in support of the resolution I uh thank you uh to um CSA who's uh celebrating this week at a Statewide level I um I'm I I get involved in these things and so I know them fairly well uh when organizations are are doing a broader uh movement and so thank you to those who've been out there uh stepping up to support our schools and to get uh to to keep things going uh you are uh you know Central employees and thank you for the the work that you've done I also uh would like to uh Beyond um uh classified employees I would also like to recognize I know that this is for classified employees

375but also recognize some folks mentioned lun lunch ladies and other folks I I'd like to recognize Teamsters who were out there uh as part of uh the distribution of food for such a long time uh Pro providing massive amounts of food and so if we're going to go ahead and have a month-long recognition I would suggest that we also provide a monthlong res recognition to our teachers who uh some of them were out there U exposing themselves putting themselves at risk when they were providing very very important nutrition to our children while they were um while they were still and they still are they're still doing it so I also I will bring that forward myself thank you trusty fam I want to speak in support of the resolution uh you know if teachers are

376Central Casting then our classified staff is like the back the people behind the curtains working with the lights and uh the the set decorations without them our our our school sites would not be operating uh also uh you know a little bit from personal experience some some sometimes it's the the classified staff that play a role in a positive role in students lives whether it be the yard Duty person the school secretary who uh mediates once in a while between a teacher and a student uh you know the the heror professional who keeps an eye on you know a student in trouble in the classroom our our classified without our classified employees we would be in a much worse place so I I I intend to vote in support of the resolution to recognize the

377important role that our uh classified employees play on a daily basis in our District thank you very much thank you trusty fam trusty Beano yeah I'll just quickly build upon the comment made by trusty fam and and he said that sometimes the our classified staff are are significant relationships for our students I would I would even bump that up to oftentimes um you know it's a small difference but I do think that there are very significant relationships bonds Rapport that's built with those staff and so 100% agree um and in the interest of time I you know I'll just say that if teach are teachers are our heroes um you know our classified staff and other support staff are are the unsung heroes and and I would agree that they should not be unsung for

378me they're not un unsung I I remember the relationships I had with them as a student and my daughters um and so you know I'll leave it at that in the interest of time thank you thank you so much and the only thing I'll add uh before going to vote is that um classified staff often um are that one that uh take the extra time and um sometimes even save save lives um taking that extra step making that extra phone call spending that extra two minutes with a student um so thank you to all uh and definitely the the glue to you know the student and learning and ensuring that you know the student um is able to understand that information get the extra support they need um whether it's playing out in the ground

379um you know to getting that ball to understanding that math problem that they couldn't understand to spending individualized time um so thank you so much um for supporting our students and teachers um out in our schools so with that we'll go ahead and go to the vote uh trusty wano I trusty fam I trusty Chavez I and vice president kto I myself I passes unanimously uh moving on to item um 803 move to approve move to approve by Jano second second by trusty fam um Dr Bower is this something you're gonna present on or I respect ask the board to approve we need this position all right we'll go ahead and open it up for public comment at this time there are none I'm sorry there's one now okay uhas welcome back missas soon as

380you begin missas sorry it took a while I just got the unmute right now um I just wanted to say that um I fully support this type of position because I have seen um a lot of the grass right this is the biggest maintenance of our schools when people come in this is the first thing they view the grass the weeds all that stuff and I think that our MLT does need this type of position and um it's needed um I just didn't see the pay for it um I don't know if maybe that's not public information um but I do think that this is a really dire need for our schools especially um with you know Fire season coming and a lot of the stuff and a lot of the work that needs to

381be done in our schools so uh whoever brought this up thank you um and that's all thank you um anybody else Mr Monon no more comments okay trusty Chavez I see your hand up yeah um I'm in support of this but I have a question on the wording on the first paragraph under the definition and it says an offsite improvements um if this is for the district sites then why is it saying here off S sites because um I don't want it to be uh how should I say I mean I want all the improvements on site why would that wording need to be there offsite improvements I could see if it's across a street but um it can get a little bit um can you redefined offsite please under definition first paragraph Dr Bower

382I'm and I just want you guys to know that this was uh negotiated and agreed with Teamsters so there must have been a reason we cannot bring job descriptions and change them okay was already negotiated with Teamsters but Mr um Mr Chen can explain what that means because that's the question welcome back Mr Chen thank you Dr par um I'm going to respectfully defer this question to Mr Moran um he worked closely with um um Teamsters to come up with this J description Mr Mor yes I'm so offsite so what we did was we had a a previous job description that was a maintenance three so we had to create a maintenance for position uh this language was previously part of a maintenance 3 so we did do several updates to uh make it appropriate

383for the backflow uh item or the backflow uh is very important for that in regards to off-site improvements my understanding is it's not offsite as as property that does not belong to alumrock so for example it might be uh near the curb side uh not directly on the site uh like inside the yard so it could be like say near the walkway outside of a school but it's still on our property it does not in any way mean offsite as far as uh someone else's property could could that be put in the language that it's um I think Dr it's questionable when you put off site this was already negotiated and you we already provided an explanation we would have to wait bring it back whatever you add or delete we have to take it

384off go and negotiate and come back and we need the position but it's up to you um well and I still see your hand up trust Chavez I don't think you took it down from the last comment um but I trust the negotiating team you know I trust that our um Team sat together and left that on there um for a reason and so so um with that um if I don't see any other hands up I will move to H vote to a vote now so with that we'll go ahead and uh move to a vote um trusty Chavez I don't know if you just keeping your hand up or that was from earlier no this is from now okay go ahead okay um be I mean I'm for this position but because it

385says offsite and it doesn't say only specific Allen Rock properties then I'll be voting no thank you thank you uh trust GTO so under your M president uh speaking through you under that logic then we would have to go ahead and limit that and when uh somebody one of the supervisors send somebody to go and mow the lawn on a park strip then they're going offsite and at that point in time it's they're working outside of the of the of the prescribed duties within the the agreement in that case all of a sudden we'd have to go ahead and call another firm to be able to mow that lawn because it's not on the School site proper right I don't understand the logic of limiting ourselves to um when this is actually expanding your ability

386to deal with things like small things like that as was mentioned by Mr Moran which is is curbs small things that are outside of our of our property so so I'm I'm going to be fully in supportive language okay and vice president I just want to clarify because you were directing that to me I'm in support of this no I'm speaking to you because I'm not supposed to be speaking to other members of the board we're supposed to have a conversation with President perfect thank you um I'm also full support of it um I see Beano's hands up and trusty Chavez we go ahead and go trusty Beano I'm just requesting to call for the vote we have things that we still need to cover and it's been clear where people stand on this so

387um their feelings will come out in the vote agreed we'll move to the vote um trustee F uh no no I had no comment uh we're going uh for the vote for some reason my pictures moved so I trusty Chavez trusty Chavez trusty Chavis can you hear me I can hear you now I'm giving you my vote I trano I vice president kto I myself I passes unanimously moving on to item 901 uh Madame President uh in the interest of time uh let's see here where is it could move to take up the entire consent Calendar please yes I second of time um uh tro I'd like to pull item 9.09 9.09 okay trust Chavez uh nine I want to pull 9.09 specifically March 11 so 9.09 okay any other items okay so um everything

388except for 909 um we'll go go ahead and uh open it up for public comment at this time Mr Manan we have none okay seeing none uh we'll go to the trustees um any questions comments concerns on 901 through 908 okay uh trusty Chavis I see a hand up I'm not sure if it was from the previous comment sorry it was from previous comment okay okay so we'll go ahead and move to a vote uh trano what was the so the amended um do we have an amended um motion yes so we are right now uh voting on item 901 through 908 so all everything under the consent calendar except for 909 yeah I just wanted to make sure that whoever made the motion I had amended it a second to that Amendment is that

389accepted by the person who made the motion I don't remember who made the marel can you remind us I want to say you was trusty uh fam fam trusty fam are you in agreement with that yes yes okay we are in agreement with it um trusty Chavez yeah I think you said except for 909 I think said 901 no I said you said 901 I said 901 what did he say Oh I thought you said 909 I'm glad you're no I said 901 we were pulling 901 and 909 because you said also 909 but specifically x March 11 yeah so you meant 901 thank you for clarifying so 901 and 909 I said 901 so trusty fam are you in agreement with i h yes yes I am as well so now the is 909

390through 908 is what we're voting on um okay now that that changed we're now voting on items 902 to 908 yes yes but we're taking it out of order so we're voting on 902 through 908 first and then we'll come back to 901 yes okay Soo hi Cam hi trusty Chavez hi vice president GTO I myself I okay so now coming back to 901 go ahead Chavez uh on the 901 under March 11th on the page 15 of 17 uh I want to make sure that it gets put in there because he was racist against Mexicans and that he um on the line that he would go beat up the workers that were trying to to get in work at the labor Fields um I W to make sure not just to call them a

391racist but the reason behind why I call them a racist and that there's video footage of those facts thank you marel did you get those edits I just want to make sure that we have those I could send them to her thank you can she please thank you okay all right um do we need to open it up for public comments before we yes public comment Mr Moran any public comment none at this time thank you trust I just wanted to truste's um reest I just wanted to make sure that we run that through our Council because it has been explained in here I think on numerous occasions that the way minutes are docu dou mented are documenting the very general um occurrences during the meeting and not necessarily specific granular detail so I don't

392need to have a conversation I just want to make sure that Council um is okay with that and so I would support that Amendment with that um Assurance thank you uh trusty Chavez and I am entitled to my opinion so I would like that on the record thank you okay um and so yes I agree uh with trust Gano let's make sure to confirm that with uh our Council um and for uh purposes of time we'll go aad and move to the vote um so just clarifying just pulling out March 11th with um uh clarification with Council and then edits that trusty Chavez brought up we'll go ahead and take it to a vote trusty Bano it is also part of the motion that the edits will be reviewed by Council is yes okay so

393wait make sure the person who the people who uh made the motion and seconded if you're in agreement I don't think there was a motion or a second because trusty chav only spoke about her edits and um I don't so then the pre the rest of the consent is a one that there's a a motion and Second Amendment so that's how it 902 yeah vice president um I want to speak against the proposed motion because the uh Council already explained to us that we don't have a stenographer here um there isn't some sort of a court reporter uh and that they state that the the minutes are intended to be broad just general kind of what happened not word for word um and so therefore I wouldn't be supporting the the proposed action that's been

394proposed okay thank you trust Chavez uh I'd like to propose to bring back the minutes so that we can hear from Council for the May 11th Mee excuse me the the 11th meeting of March trusty I will concur with trusty K I also would not be supporting the motion on the floor for the reasons he stated so if there's no support for the motion of the floor the motion well you you still have to see if there's a second to right I don't hear any oh okay I don't hear any support to the motion So based on that the motion fails right okay so is there any other motions at this time on this item I motion to no one again I move to approve item 9.01 I second um with that open it up

395for public comment Mr Manan we have none uh um trusty CH I see your hand up I'm not sure if it's on this or previously okay like I stated before that when loano Smith had that confence that I and uh the secretary will both in it said that the no vote can can they can they should put it in the minutes and it's recommended but this was from another loano firm that we also employ so um like I said um I think in all fairness there is a no vote then why not let the person if they said that that's you know out of courtesy to them thank you thank you um I do see a motion on the floor we only have 12 minutes left uh Beano I see your hand up um last

396comment before we go to vote yeah I we're just going to say there's a motion there's a second but I do think it's important I agree with Tessy Char that she has her right to her opinion to be on record and there is video record of her making the statements that she's making and so I think it's important that we acknowledge that those statements are on record for her own um you know to ease what she wants and I think it's important that those comments are on as well and I would call for the vote at this time thank you trano I TR fam no no no no trusty Chavez no vice president GTO this is for approval of the item correct just approval this is for approval of the item with no edits oh

397I I'll change my vote to yes sorry about that I misheard misheard the question I for me okay I for me as well um passes and with that we'll go to 909 justess witho uh yes just very quickly as quickly as I can um I in the spirit of of everything we've been talking tonight about teachers um you know anytime somebody retires it's it's a joyous occasion and it's a sad occasion um certainly and and there's two particular individuals that have number one impacted My Life um personally um as part of the Shepherd Community Shepherd family my daughters went to and attended there and Mr Greg Kellerman and Miss Linda Templeton um had a very positive impact on my daughter and also a number of daughters or a number of of students and this is

398not only a statement of my personal experience with them I want to thank them for what they've done but the way that they impacted them was through the sports programs and so I think as a district um thing this you know it's it'll be a loss to lose these two individuals who were impactful through the sports program but the impact that they had on my daughter through Sports is um is something as a reason why we support Sports acade I mean athletic programs in our district and it's something that we're proud of as a district so thank you Mr Keller Kellerman and Miss Templeton and um everyone who provides Sports in our district and that's it for that okay thank you and at this time uh we'll go ahead and um are you so um
