002president member min pham president members of administration superintendent dr bauer president thank you uh so today i'd like to uh acknowledge um as an indigenous woman of the wedarica nation um and member of i want to first acknowledge that we are guests here on the ancestral homeland of the maloney and pledge my solidarity to them in their ongoing fight for federal recognition as a tribe and i want to also acknowledge that tonight our meshica community will be celebrating tonight friday morning at 12 45 a.m uh march 12th we'll be celebrating our new year so we're on the eve you know our second uh board meeting in a row um celebrating on the eve of our new year our aztec mishika new year and i do want to honor and tell you a little bit about
003our new year and what we're celebrating today we are celebrating which means nawi is nine in the nawa language and kali means house so nine represents the wind the rain with which both help flourish life and it represents balance and is a center and beginning of the development of experiences in life which is a time of constant learning those born on this day are very centered and creative dali means house or a building kali is something that protects those born on the sign on the day of kali are creative protectors and enjoy spending time with their families they are people who study work plan ahead enjoy being at home and are known being the person who gathers and prepares to have all the basic necessities this meshika new year we ask everybody to join us
004in celebrating and celebrating the protection of our home of our communities and uh we encourage everybody to just join us with the thought you know honoring our indigenous people of of this land of the americas um as as we come together typically there's about 10 000 of us that gather at the emma bridge park this year it will look very different uh but there will be an opportunity to um join online for those who would like um but we we are entering our ceremony so just want to honor um our ancestors you know again i i like that quote from maya angelou i stand as one but represent ten thousand um and so just honoring all those that came before me thank you for that and with that we're going to move on on our
005agenda but before we do that um can you please explain to us uh about translation okay uh now we'll move on to item 102 discussion and or modification of the agenda any changes from any of the trustees uh trustee chavez uh you're muted if we can mute her or you can meet yourself uh oh okay thank you for putting that up there um can i please move 602 before 601 so 602 before 601 yeah um i would like to move uh 504 uh the um the resolution denouncing api hate crimes earlier in the agenda and um i i think that um it would be right you know right around the 3.01 either before or after whatever you deem is most appropriate so [Music] and if we bring that up to three oh um let's bring
006it to three you said before after yeah either or before or after let's bring it after okay so after 301 so we're moving 504 after madam president on that item the trustee quintero moved i just want to let the board know that we're gonna have uh a special reader in vietnamese and we're checking to make sure he's here because you know the item came a little so if you're okay yeah we will check if he's ready but that's what we're doing right now to make sure that he's here oh okay yeah if um the translator's not available then we can just delay hold off thank you okay thank you any other changes on the agenda uh trustee i i'm not sure if you were just gonna do this after but i know we have the
007pledge of allegiance to do also i believe so no changes to the agenda but just that thank you for the reminder thank you thank you so we before we vote on the um on this item we'll go ahead and do our pledge of allegiance uh trustee chavez was there any other changes to the agenda i don't think i heard you say we have quorum did you uh when we um went through roll call but i'll go ahead and do that before we do our pledge of allegiance any other changes to the agenda otherwise we'll vote as soon as we're done with our pledge of allegiance okay see none we'll go ahead and do our pledge of allegiance if you can join me in standing up and doing our pledge of allegiance i pledge allegiance to
008the flag of the united states the united states of america and to their to the republic for which it stands one nation one nation under god under god indivisible with liberty and justice for all thank you and as uh trustee chavez pointed out we do have quorum we have all of our trustees present here today thank you uh so we'll go ahead and uh move into the vote for our changes i'm going to go i'm going to review them we moved 602 before 601 we moved item 301 i'm sorry 504. um after 301 so after that and those are the only changes we have any uh anyone opposed to the changes no okay um you do trust each other is there any way that i can move six so two before we vote on the
009one that uh trustee quinteto asked form we're just working on all the changes together so are you changing now your thought are you changing your no no i i actually should have said which i didn't was because it deals with fiscal responsibility that i thought that maybe we should do that before we vote anything in today um i'm not sure what you're recommending so i have your change at 602 601 are you changing that recommendation uh if that's okay with you guys uh we haven't built it on so just let me know are there any other changes that's it okay uh what changes what what change would you like right now the one that i heard was you want to change 602 before 601 uh i believe if the board allows uh 602 before 601
010but also before so are you saying to hear 602 after our public after i'm sorry item 302 which would be correct okay did everybody get that i wanna i know uh mariewell you're getting notes is anybody in opposition of hearing item 602 before item or 504 after thank you yes i just want to make sure i have it hang on i i think i have my hand up there uh okay i'm sorry mr uh i you know i'm not so you know i think i i would be opposed to it only because uh i believe resolution 602 has to do with items you know item 6.01 so i think that you know they should be heard in in the same general vicinity here you know i mean personally i would think that you know it
011should be attached to you know the relevant financial information here so i you know i would i would oppose you know i would oppose placing item 6.02 you know even before 5.04 in this case i would not mind it i would not i mean i would be in favor of it before item 6.01 but you know i think it's uh you know it wouldn't it would disjoint the uh budgetary discussion if it were moved you know earlier then you know it's a lot of time on the board agenda thank you mr femme anybody else okay uh seeing none i guess we'll go ahead and um break it down to each uh recommendation i'm seeing that there is somebody in opposition so we'll do the first change um if you can vote if you're in agreement
012to move 504 after 301 if you can i'm going to go down the list chavez 504 after 301 but not before we're doing item before item by item so we're going to start with that one 504 before 301 okay i'm sorry and you say 504 after 301 okay so where does that mean so if you also mention uh a little bit further before 602 or after 602 it's birth clarification we're not looking at 602 yet we're only looking at 504 i'm going to take each one by one okay so we're just looking at bible okay so are you in agreement to that sure okay uh trustee vajrano that's fine with me uh trusty kingdom trusty king dead muted oh all right i'm having trouble with my new button yes okay uh trusty fam hi okay
013so we'll move 50431 now we'll move on to 602 um linda suggested to put it and make sure i get this right trust each other to put it before item 504 before item 601 and before item correct which would be okay so trustee chavez is recommending for item 602 to go before item uh so we'll go down the list trustee chavez yes and i by the way i i i wasn't i i yes for the first time i don't think i voted sorry about that so trustee chavez yes on that change trustee bajarano i mean i'm kind of indifferent but i'll just say um yes i guess trusty fam no board vice president quintero uh no and myself no so leave 602 um okay seeing no other changes we'll go ahead and move on to
014item three oh i'm sorry my computer here by the way i'm trying something different to save people we'll go ahead and we'll go ahead and go to item 201 uh the local control accountability accountability plan update information only dr bauer is there somebody to present on that yes i think sandra garcia is ready to do that okay welcome ms garcia you're gonna do her there welcome we can hear you now we speak hi um would you like me to share my documents i'm not sure how to do that on this new format um your presentation is there a way to share my screen i think sharing yeah now you can start sharing um do you see it not even um she is a penalist um yes i i don't see it i don't see it
015but i i i'll give you access so you can okay okay thank you you should be able to share your screen um yeah i don't i don't have a share screen option [Music] there we go thank you okay all right you see it now yes okay good okay good evening uh president lloyd herrera superintendent dr bauer board members and community um sandra garcia i'm the director of state federal programs and i just wanted to provide an update for you on where we are on the development of the local control accountability plan and i'm going to share some information on stakeholder input this evening so my objectives for this presentation are just to review some of the cd requirements for our lcap process this year share some of the progress with our lcap share the process
016that we are using to gather the stakeholder input and where we are so far some of the work that we are doing with the lcap advisory committee and then the next steps in the elk cap adoption process just as a reminder these are the eight priority areas that much must be touched on in the lcap um and two the two at the top nine and 10 are for county office of ed only and the rest are required in every lease lcap okay so for this year as you remember last year there was a pause on the development of the new three-year lcap due to the pandemic and we were asked to replace the three-year lcap with a one-year plan which was called the learning continuity plan and now we are back to back on schedule
017to develop the three-year lcap and that will go for years 2021-2024 and required in the lcap are the same requirements that have been in the lcap involved in the lcap process in the past which is the annual update the goals actions and services are required to be written into the lcap a plan summary uh a budget overview for parents which is i did share um i'm losing track of time and i think we shared that in december with the budget the with the final budget and um but we will be sharing it in june along with the three-year lcap and then it requires to have stakeholder engagement and um a presentation on the local indicators as part of this process this is our our timeline for this school year uh at this time we are
018in the middle of our input forums with our community with our staff and students we are also gathering input with our advisory groups our dac our dlac our we have one scheduled with our union groups as well as the survey that is in process at the moment with our parents staff and students in april i'll provide another board update and in anime i will bring a lcap draft to the board for review then i will take it to our advisory groups for their final input and then in june i will we will have a public hearing to gather more stakeholder feedback to the plan and we have a board meeting set on june 24th for approval of the lcap once the lcap is approved by the board we'll take it to the santa clara county
019office of ed for approval and that needs to be done by july 1st so this is uh the process very similar to what we've used in the past we the stakeholders that we gather input from our parents and community our staff members and our students this is the way that we gather input we have input sessions for our advisory groups including the groups listed here our dac or dlac our lcap advisory committee we have community forums which we just had the last one this week we have every site has their own input session for their community and for their staff and we have added lcap sessions for middle school students this is the second year that we will be doing that with our students we also have the surveys that i mentioned earlier for parents
020staff and students the content that we share during the forum the input forums are information on the lcap the purpose of the lcap uh and the purpose of the input sessions we review some priority areas um that are already written in the current um lcap the goals and the actions uh we share information on funding so that stakeholders understand how lcap funding is generated we share some data on student progress key initiatives that support our lcap goals and then we have an input session for those that are present to share their input into the process the surveys um these are the three surveys that we um give and this is the fourth year that we've been giving this survey to students staff and parents and the only part that i wanted to add on was
021that this year we've added a cultural awareness and action survey for students and for staff these um just want to share a little bit on the surveys that we've been able to do over the past year fall of 2019 [Music] we had 26 a little over 2 600 parents take part in the survey last spring which is not surprising you know there was a drop in participation and that was like right in the middle of a pandemic and we were having a lot of surveys going out as well um in terms of the pandemic itself and and then this fall we had about 2 000 parents take the survey we are now in the middle of our spring 2020 survey and we are pushing to have even more participation for the spring survey it's still
022a little challenging though due to the you know everyone being at home and students having to take the survey at home and as staff as well so we're pushing and we're trying to get more participation a little bit on the lcap advisory committee we meet three times this year we met in february discussed a little bit about the process and how to make some adjustments due to the fact that we will be having our um our input sessions um virtual work and um also to get some input from the group on um the survey and the the um outreach that we do to our stakeholders in april we will meet again so that i can review the new outcap template with the group and give them an update on the progress um on our lcap
023development and then again as i mentioned earlier in our timeline on may 27th we will meet for the last time so that i could share the copy of the lcap draft for their input so next steps in this process are um to provide opportunity for stakeholder feedback during our input sessions and survey um hopefully by the end of this month we'll be done gathering that input and then um i'll bring another update to you in april on the initial lcap findings thank you so much do we have any questions from the board for miss garcia and um please raise your hand because i cannot see you there are any use a raised hand function okay now i see most of you okay um uh trusty with an o yeah i just i wonder if um
024maybe we could take public comment and then maybe have another opportunity for uh board com questions or discussion i'd like to hear the public and and you know my comments or questions may be reflective of some of that comment so it's just a just sure sure i don't see anybody else's hand up so we'll go ahead and go from trustees uh i know we have god rules more than helping us today with the comments uh carlos thank you so much do we have anybody who's raised their hand from the public carlos uh yes board president we have anna robles if we can cue her in and unmute her mrs robles welcome and as soon as you begin speaking well the timer will begin buenos hey you can hear her okay okay i share the language

027who will check in with them and their families on the regular basis and as soon as it is safe to do so students will be spending time at dell headquarters visiting with their mentors and engaging in stem experiences that will build their skills and hopefully inspire them to pursue a career in high tech finally we are also working on making sure that those relationships and skills lead to a paid internship to help these students pay for college and thank you so much for your attention appreciate that thank you mr moran do we have anybody else yes we do we have uh someone by the initial a carlos have you um i can hear you i'm wondering if you went back to spanish okay okay okay i'm sorry uh mr moran anybody else yes we have

035uh barrett fischer welcome as we've been seeing the timer will begin uh hello uh good afternoon can you guys hear me yes welcome thank you um i just wanted to ask someone to the last person who asked um if the uh the plan in uh to to repurpose up to from we've heard ten schools and to try to rush it in a week in order to make savings of seven million dollars based on the last repurposing facilities meeting you guys that you would save 10 to 12 000 per children by moving them and merging them into already small schools during corona where we're planning on overpopulating these schools that already can't handle the capacity it's currently at so i'm just asking if this is kind of a rushed plan to erase the deficit of nine
036million dollars and in doing so are you not harming the future of this community thank you mr moroni yes we have a you welcome i believe anna as soon as you begin the timer will begin um again i wanted to know um good afternoon um i wanted to know if they can explain you how our district get a deficit of nine million dollars um i think that's the parents um we deserve an explanation and while we're we're spending this this kind of money thank you yeah any others mr moran yes we have uh three more we have anna robles welcome as soon as you begin speaking a timer will be begin i can hear you i can't hear miss robles uh foreign okay yes um is she done will she please see okay see again

038brenda cinderella's next uh okay let's try it again as soon as you begin speaking the timer will begin is i'm not sure if it's her can you hear me hello yes we can hear you now welcome hi board members uh trustee president uh today i just want to remind the board and superintendent that we continue to keep our students safe in schools in the pods and that we ensure that they have sanitizer mask and water bottles at all times because i am hearing from parents that this isn't happening and this is a concern of mine that we ensure that this is always accessible every single day when they come into these pods and that we are providing them even for the programs that are coming in and hosting these pods for our students that are
039doing this for free so i just want to remind you guys to please ensure that these pods have sanitizing gloves water and wipes or spray to clean after each pod um that is all for today thank you thank you mr anybody else the public wanting to speak board president that's everybody great thank you so much we'll go ahead and move on to item 504. and i i believe uh dr brower you mentioned we may have a speaker on this item we do have a translator on the resolution as the author of the resolution i would like to speak to this and then afterwards it can be translated perfect welcome aboard vice president quintero so uh uh colleagues uh and members of the public thank you for the opportunity to bring forward this item on the
040unfortunate reality that we've been observing is that there's been an increase in hate crimes against the api community as uh has been observed throughout social media um this is in particular something that's very uh painful to observe i've seen many times when a rash of of of crimes against certain groups for example we have a lot of of members of our latino community that happen to sell products on the street to make a living and time and time again we see a rash of attacks against them uh their their products are being thrown over and they're being told to go back to their country while they're being robbed and so it becomes very personal when you see it happening that way to your community and if and now we see it you know taking place
041again and again against the api community and so it is for that reason that i've um uh found it important that because if one of one group in our community is unsafe then we're all unsafe and it's not it's not um right to simply stand by and and see it happen and so um i do i appreciate my colleague uh board member min pham for agreeing to co-sponsor this item i do want to go ahead and give credit where credit is due and that is to the uh asian pacific islander legislative caucus in the california state assembly that provided the template for the uh the document that we have before us today i also want to thank uh someone remember los aleko who actually sent it over to me and provided the template to myself
042directly so i appreciate those individuals who have been involved in the process at this point i think it merits the item is significant enough that it merits a reading of the whereas is as well as the result of the resolved language and so if you'll indulge me and allow me to read it um i'll go ahead and do that at this point uh whereas the asian pacific policy and planning uh council in the chinese uh for affirmative action launched a hate incident reporting entering a website stop api hate at the beginning of covet 19 outbreak in march of 2020 whereas the stop aapi hate reporting center reported over 2800 hate incidents against asian pacific islanders americans in 2020 whereas discrimination and racism towards apis has always existed such as 19th century skateboard scapegoating of apis
043also known as yellow peril whereas racism hate hate crimes and negative rhetoric towards apis has been exacerbated by kobit 19 pandemic and whereas politically charged and culturally insensitive language referring to covet 19 as the chinese virus or the kung flu further encourage racism prejudice and hate crimes towards apis whereas a promotion of such language by former president donald trump during his term further propagated anti-api sentiment in light of kobit 19 and whereas on january 31st 2021 three elderly asian americans were assaulted in the city of oakland's chinatown district including 91 year old asian man who sustained serious injuries such as lacerations abrasions and contusions to the left thumb in what is deemed a hate crime whereas on january 30th 2021 84 year old visha a nearly blind and gentle elderly thai man died from injuries
044resulting from an attack while he was walking in the city of san francisco in what is deemed a hate crime whereas 31 percent of asian americans reported having been subject to discrimination since the beginning of covet 19 pandemic according to a pew research center report whereas asian americans in the city of california are increasingly concerned about their safety and well-being given the rise of hate crimes and other racially motivated attacks whereas asian americans in the state of california are more concerned about the safety of themselves and their family that are current that are currently a high risk of being targeted and whereas in 2020 the california state legislature's api legislative caucus spoke out against anti-api hate crimes in an effort to stand up for immigrant and refugee individuals and now therefore being resolved that the
045alum rock union school district on behalf of the district all residents thereof denounce anti-denials hate crimes hateful rhetoric and hateful acts against asian american and pacific islanders and reaffirm our commitment to ensure that api americans feel safe and welcome both during this covid19 pandemic and beyond further be resolved that the clerk of the board of elon rock school district transmit copy this resolution to governor gavin newsom u.s senators palia and dianne feinstein congress member zoe lofgren state senator dave cortezzi and state assembly member ashkara thank you for indulging me in that and i would ask for my colleague's support in this item when the vote comes wrong thank you board vice president before we go to trustee's comments um or questions miss uh dr bauer did you say you had somebody that was gonna present
046it in vietnamese yes he's here mr tien pham our wonderful community liaison at shepherd always ready to support the district and our families good evening welcome to my screens know how i look like sorry go ahead and uh begin thank you uh we didn't research foreign um thank you mr fan linda i uh move to approved uh anti-api hate crime 504 okay trustee chavez mr pham second okay um before we um go to the vote um i'd like to open it up for public comment and then um trustee's comments or questions uh i'll go ahead and open up for public comment at this time mr moran do we have anybody from the public would like to speak on this item this time there are no hands raised okay i'll count to five okay anybody raise
047our hat yes we have uh two now uh first speaker is ana robles robles welcome back to history hey espanol foreign wow foreign i need your answers for all of you you are in charge or you are not anymore in the meeting okay gracias senora robles [Music] and uh dr bauer do we have rogelio on the line today yes he is okay um rogelio would you like to just to remind everybody here today about um public comment or this time if you can uh just explain how we're not um allowed to answer questions at this time yes i'm happy to do that and i apologize i'm also having problems with my camera um it's not letting me show my face but um if the the agenda always is required to have a section for public
048comment so that members of the public can comment on anything within the districts or the board's jurisdiction however if if an issue is raised during public comment that is not already on the agenda then the board cannot respond because the only the board can only discuss those matters that have been properly agendized if a person is making a comment during the public comment portion even though something is on the agenda later on in the evening then the board can wait until that agenda item is called to address those questions that might arise in that way it's properly discussed at the time it's noted in the agenda thank you mr rogelio if we can go back to public comment uh carlos i think you mentioned there was other people in the public to speak yes we
049have uh someone by uh two names now we have carrie welcome carrie as soon as you begin speaking the timer will begin dna us that okay thank you and i just want to remind the public that we are on item 504 and we are talking about the anti-api hate crime resolution presented by board vice president quintero um and co-sponsored by mr pham um so uh carlos do we have any other uh public members wanting to speak to us in regards to this item yes we have emma welcome uh okay one second i sit down with his hand up i don't know if it's yes just very quickly and i know you mentioned that we're on this particular item but i do just want to remind people maybe they don't know and so when we're on
050the item that's the item that the public comment is for um for this item or any other item i just wanted to make sure because thank you for mentioning that we're on this item i just wasn't sure that it was clear to the public that any item that we're on that's what the public comment for that item should be on thank you yeah thank you for reiterating that yes just want to repeat that we are on item 504 approve anti api hate crime resolution that was just read uh so just reminding the community that this is the uh item that we are giving public comment on okay welcome mr siga and if she is if she come back please let her know uh mr muran do we have any other members okay is okay so

053know discussing this with me and you know uh helping to to you know get this item on the agenda here you know it you know it's a sad you know it is a sad state of affair you know a couple days ago i just heard about a you know a vietnamese man walking in the park being assaulted uh with serious injuries on the vietnamese radio also so you know i i think that this is a you know a timely teachable moment you know given that you know one out of five of alum rock students are of the asian american and pacific descent you know you know we are a diverse community and you know it you know for for us to succeed you know we we all have to learn to work together play together
054and grow together and i you know and you know in in that spirit you know it is important as a board of education to you know let our children know and families know that you know acts of racial violence is not acceptable in any form and towards any group so you know with that i i uh again uh thank mr kin fan for pro you know in vietnamese we say come on thank you for translating that into vietnamese and i urge a uh yes belt from my colleagues thank you very much thank you mr from uh trustee yes thank you um i was gonna say more things but in the interest of time i'll just point out this part that i think first of all i want to thank trustee quintero mr pham who is
055a good friend of mine from for many years with my daughters in school and i i want to thank mr quintero for bringing this to us because it's important um that we point this out not only i mean primarily because of what's going on but to think back about what we worked on several months ago in terms of our vision and mission it's right there our vision is all alum rock students will be ready for the future in a diverse and competitive world and the mission part of the mission says that we're preparing students for 21st century learning that builds upon our culturally diverse community to prepare our students to be lifelong learner learners and other things so i think this is important number one because it's important to talk about what's happening now and
056to do our best to protect those members of our community number two because we need to be models as best as we can for for you know our students and and our school community and number three um i think it's important because if we create a vision and a mission and we just had our strategy our retreat um recently to kind of continue this work it's important that we actually are utilizing vision and mission as part of how we do things and and not just have them as pieces of paper filed off somewhere so so again thank you um everyone for your work on this and i will be supporting this tonight thank you any other members of the board um i sing none i'll go ahead and say my piece and we'll go to
057a vote um just want to echo what mr vegeta just mentioned it's important to stand with our community especially when uh there's violence happening and so thank you so much board vice president quintero and uh trustee phem for bringing this item to the board and bringing it to light um we uh as uh as at the ellen rock school district do not condone any type of violence um towards anybody and so um at this time i will also be supporting this um and with that we'll call the vote i'll go ahead and start with uh trustee chavez yes hi trustee thank you trustee pham aye trustee veterano aye board vice president quintero hi and myself i passes unanimously thank you so much now moving back to item uh six no hold on one second that
058didn't pass so we're gonna go back to item five actually i believe it's 4.01 common yes okay yes thank you 401 so we'll go ahead and start with uh the teamsters um comments anybody here in the audience from the teamster uh please raise your hand and we will on you you at that time welcome mr do we have anybody in the audience from teamsters i have uh [Music] someone under the name teamsters great welcome teamsters uh this is your time uh good evening board members and uh superintendent this is uh tom foo from the teamster just want to chime in tonight just to you know say say some uh some comments on uh you know we're we're uh i know we're going through some rough water at the moment uh but you know what we're
059on board with with supporting the district as far as you know reopening as soon as possible and we're we're here to support the district in in any way possible to uh to get our student back uh to our schools and even with the uh the you know hybrid model if if that's going to happen i know that will be uh because of this uh pandemic situation we're in but i just want to let you know that the teamsters are on board and will support the district in any way possible going you know forward and hopefully we'll we'll get there to the end of the tunnel with the with the brighter light thank you very much thank you uh do we have um anybody here from california school employees association csea um looking i don't see
060um cca please raise your hand over here on behalf of csea and if there isn't any we'll go ahead and move on to alum alumrock administrators association uh yes we have maria martinez welcome ms martinez as soon as you begin speaking oh you don't get a timer sorry uh that's what happens when you repeat things over and over welcome uh director martinez hi good evening alan rock school board and superintendent bower believe it or not our schools are busier than ever the vapa section on the alum rock website is ready to go and is currently showcasing the contributions of the black history month expressions contest as well as the legend of sleepy hollows performance from joseph george middle school it can be found under the department's tabs so please check it out i guarantee that
061you will be amazed by our students work also february seems to be full of fun science activities throughout the district at ryan's steam academy they continue to work with the first and second grade families through weekly parent academy and this is a partnership with evergreen valley college ryan's teachers continue to share valuable strategies with families to implement at home and as well as a preview of what students learn the following week at adelante dual language academy they are currently working with small science a non-profit that delivers science workshops to all classrooms from tk through 8th grade and these are fun hands-on activities that are done online small dropped off all of the materials for students to be able to use during these interactive science lessons and they are very engaging and on march 2nd san
062antonio elementary had its second epic build design challenge called get in the game and this was a year where san antonio hawks and their families took on the role of game designer in this role the san antonio hawks tk through fifth grade engaged in the engineering design process to develop a new game and they were super impressed with the amount of effort and creativity that hawks put into designing their games during during the epic bill night the school community came together and schools shared with others their design process the ways they i iterated and how to play and as a school san antonio has a focus on coding and engineering design and they recognize the importance of providing students opportunities that prepare them for the careers in silicon valley and of course we are still
063working in collaboration with nasa to virtually take our students to space in february we launched the perseverance rover and now in march we are learning all about getting ready to head to the moon in 2024 all schools are able to interact and engage with the work that nasa is doing in a kid-friendly way with lots of activities and presentations and in other news 8th grade students at fisher are participating in a global exchange project with students from singapore this project is an opportunity to learn about life across the world and different cultures and it is a an experience that students will remember for a lifetime um they partner with international schools and they present their work to multiple audiences and the partners in this initiative are scowy the santa clara county office of ed uh
064school to home silicon valley education foundation and canadian international school and what would school be without movie nights and family nights adelante two and its pta are hosting zoo movie nights and students can come by the school to pick up their popcorn and drink to enjoy before the show safely at home also lucha recently hosted a magic night with a magician and that was done virtually as well and we continued to do great things on our campuses at meijer there was recently a little lending library book donated by access books bay area and students can pick books from it when they go to do their uh materials pick up so there are a lot of great things happening in our schools here in alum rock and lastly this evening we want to thank academic services
065for all of their amazing work in making sure our english learners are tested this year for the elpac in a safe and meaningful way thank you very much thank you miss martinez do we have anybody here from uh area yes we have area president jocelyn merse welcome miss merce good evening well i would like to at least acknowledge the significance of today being the one-year anniversary of the beginning of a life-changing historical pandemic who would have thought we would find ourselves where we are today and what we have been through in the meantime there have been many days when i personally felt like i'm falling into quicksand on a deserted island well my immediate family and i have been extremely fortunate to not have contracted kovid i am very much aware that the alum rock
066community has been severely affected either by the disease itself or by the impact it's had to the economic social emotional or educational well-being on our students and families we have all experienced the uncertainties and rapidly changing information that we receive now we find ourselves shifting gears again to begin the process of some sort of reopening of our schools when i try to wrap my head around it i'm reminded of one of those toys that my kids used to play with i think it's called the whack-a-mole you know where you hit one of the objects back down into its hole only to have another one pop up elsewhere it can never be done fast enough to get all the moles in their holes at the same time that's how i feel right now about the rush
067we are in to create a workable plan that best meets the needs of our students while at the same time prioritizes the health and safety of our students staff and community i want to thank dr bauer and others of you who are responsible for making the vaccines available to our teachers the rollout came much faster and more widespread than i certainly had expected providing more opportunity for our teachers to take advantage of it i am also grateful for dr bauer's commitment to not force any of our teachers to return to on-site instruction for this year while flexibility is a life skill i tried to teach my own kids and my students i think our teachers have demonstrated a high level of flexibility in the way they embraced and ran with implementing a solid distance learning
068program for our students i also want to thank all those in academic services who supported the teachers by sharing their expertise and resources for distance learning we have shown our flexibility but i think right now we are stretched to the max we need some stability some plans that we can count on for the rest of the school year so let's do our best to come up with a plan that will work for those students who may need that on stripe on-site instruction for a portion of their day or their week while allowing the rest to continue with distance learning area is ready to craft an mou with the district that will do so while at the same time keep the safety and health of our students staff and community as top priority thank you thank
069you uh dr bauer i'm gonna have a brief comment um i wanna echo what jocelyn said i think that all of us who have been leading this district under these unprecedented times cannot forget that a year ago i um i received that at midnight the order for our schools to be put under shelter in place and i will never forget because that night um it was non-stop for all of us that were leading a district in one way or the other i remember having a superintendent's council at 12 midnight where dr dawan had called all of us in the county and told us you know we're gonna have to shut our schools for the next three weeks and here we are 52 weeks later um we're still not where we where we were and i
070don't think that any of us will disagree that our lives all of our lives have changed considerably due to the pandemic and when i hear the frustration in the uh audience comments and and the anger i totally honor all of those feelings because it is part of all of these terrible things that have happened all around us i just want to reassure you that if you really want answers please reach out to me because i'm totally willing to respond to your questions and i just want to echo you and not remind you about that um i also want to make sure that everybody hears that there is a committee that made out of all stakes holders that as it's considering repurposing sites in november the board was we brought up to the board a demographic
071study and a lot of you have questions around the why and i will urge you the demographic study is online and we it's anybody can go to the last page of the demographic study to be able to understand the situation of the district our schools are designed to teach students that's the number one goal when trustee vegerano reminded us of our vision you know that's what we are supposed to be doing and when we don't have the number of students that are that are needed to sustain a school we gotta repurpose it and i'm being very deliberate with a term we have a fantastic committee that is made out of all stakeholders that committee was formed publicly and every major group of parents in our district selected their own representative and each of the unions
072selected their own representative in the the community there were two community members who applied and were selected all of these was done in public everybody was witness of that so uh parents those are some of the questions the beginning of the questions to the beginning of the answers to your questions let's all work on being united for our sake for the sake of our students we as adults may disagree in many things and i totally honor a diverse way of of opinions in our district that's what makes our district strong but we all need to focus on working together respecting each other and moving forward because the the the reality in our district will never be the way it was and so we are creating totally understand jocelyn's comment about the way the flexibility that
073the system has had to have to be able to transform our instruction from one medium to the next and i do honor every staff member from custodians to admins to paris to our cnn staff to our teachers principals every single 1100 staff members in alum rock i want to thank you for your commitment to our kids for your commitment for your commitment thank you thank you dr bauer and we'll go ahead and move on to trustee reports comments at this raise your time you'd like to speak at this time trustee by karano yes yes thank you so um a couple of things first of all um in it dr bauer mentioned as part of the questions that that came up you know thank you mr ruiz for for confirming that unfortunately for those who may
074not be aware due to the laws specifically the brown act we are not able to have like question and answer in this meeting with the public we listen to what you say and depending on you know where the conversation goes we may incorporate some of your um questions or thoughts or opinions into our discussion so that's kind of how it works but you can contact any of us individually or dr bauer and you know that's another way of communication but in this meeting we we just that's not the way by law that we're able to do it um so i but thank you for the questions and so in addition to dr bauer mentioning the geographic study uh or i'm sorry the the study that we had done that looked at you know the geographic
075realities of our area and and um the things that we need to consider in terms of the future of the district i also would encourage community members with questions we've had several um special meet budget meetings that also um our our fiscal person mr chang has gone over the budget and and why you know the budget is the way it is and how monies are spent where monies are dedicated to and kind of some of those questions that came up so i would also encourage looking on the website for the special board meetings that were budget meetings and you'll be able to i think find information there that will answer a lot of your questions um in the past month i know several of us all of us i think as board members have have
076been fairly active um with with regards to some of the things um that will be discussed later on on our agenda including reopening of schools we've met you know we've talked to and met with other board members and and a bigger meetings um with city officials and and there's been a lot of things going on that we as board members have been working in the interest of our district to try to preserve um you know our basically our sovereignty as a district to make decisions that that reflect what we think is best for for the community so that has been actively happening i also want to recognize and and commend our the repurposing committee that dr bauer uh mentioned you know we as board members don't attend those meetings because that's really a process for
077stakeholders and community to to be able to you know work out to talk through the process to get to a recommendation and i've seen after the fact i'm able to you know go on youtube and watch those meetings and so i appreciate the hard work that everyone there is doing and you know the difficult decision that ideally they would make to bring us a recommendation and so i look forward to getting um a recommendation because you know i empathize with that difficulty of that because as a board member we know that how hard it is to make a decision and and kind of you know be decisive and so i appreciate the difficulty that that has presented but um also the work that comes along with it by that committee um and then i think
078the just the last thing i wanted to respond to um i've had a request from a media outlet um i guess there's been some questions from the community about our as a board our positions president vice president clerk and all those things and just so i i just want to be transparent and let everyone who may not know that every december we do have elections to vote you know whoever we as a board will be in those positions and that is actually by um california law by ed code so that is a mandate if i mean if i'm incorrect mr ruiz can can correct me but that is something that we have to do every year so i just want to be transparent about the process of how these positions happen president vice president et
079cetera um as a response to a direct community question um but other than that i appreciate everyone's time and thank you very much thank you trustee um i see mr fama miss travis's hand up we'll go ahead and go with mr pham and then trustee travis okay uh first of all uh i wanna wish uh trustee herrera lower a happy aztec new year am i getting i'm getting it right so okay you know last month we were celebrating lunar new year and this month we're celebrating the aztec new year so you know you know uh may may your year be prosperous happy and healthy uh sec uh you know uh second of all i i wanted to you know like trustee bejarano mentioned i too have had defused some questions from local media outlets in
080recent days and you know i i want to remind you know members of our community that you know before jumping the conclusions based upon information put out on social media please take take the time to you know write to write to any of the members of the board and contact the superintendent's office because you know uh as we as we are entering into a time where we are making critical decisions you know alum rock is one big family here and you know i you know i i hope that you know uh you know our our community stays united so that we can get to the light at the end of this pandemic tunnel and not you know just like uh jocelyn mers mentioned this has been quite a year uh lastly uh you know i
081know if you know all the staff teachers and administrators have done great work you know as mentioned by the uh represented from the araa but i wanted to you know give a special thanks to child nutrition services for for doing weekend family meals new distribution every friday through the month of march you know i i wanted to point that you know point this this is this is your community school district stepping up in times of need so you know i i want to thank the the cns staff for you know stretching themselves and you know providing this crucial service to our families in need at this time thank you very much thank you mr from trustee tubbists would you like to trust each other uh you can mute yourself at this time and speak a
082few words um no action i'll go ahead and uh uh say a few words um just to god i can't echo enough everything that's been said um jocelyn put it well no in regards to feeling like you have one thing under control something else pop you know goes up and uh everything is is urgent everything is urgent and so um i am happy and i am proud of our lmroc staff uh teachers doing their job day in day out uh the cafeteria stuff staff feeding our community for so long um as jocelyn put it one year as of today i remember my uh 12 year old at the time was 11 in fifth grade um getting her stuff and saying mom they told us to get everything and leave and i don't know we're gonna
083come back and so you know the trauma that that causes to our children you know um the trauma that that causes to an adult it's it it's real and so our community has been heavily impacted by cobalt 19 as jocelyn mentioned we've lost many of our community members due to this pandemic and it hasn't been easy and it's time you know now some of us have gotten our vaccine some of our teachers have been vaccinated it feels like the light at the end of the tunnel but we're not at the end of the tunnel yet um and so it's really really hard um but yet you know i know it's a time that as leaders that were elected by you you know those of you who voted us to be here um that you count
084on us in order to continue to do our job to reopen our school safely for your children for the staff for the teachers um to continue to advocate on behalf our alumni community and know that we're doing that as uh mr fam mentioned mentioned we are busy we're continuing to advocate and as one um item comes up you know the other one comes up and they're all as important and we will continue to um to advocate on your behalf and i'm happy to report that we had a board retreat this past saturday where as a board we sat down we talked and we talked about the work ahead the strategic planning that we will be doing as a district that will continue to push our district forward uh we are doing um a lot better
085than we were many years ago which is great again you know that light at the end of the tunnel we're not there yet but we are moving forward um and i do see that sun rising right and and our district um in a better place even though it's it's hard times um if if you can even believe that right or feel that i know it's hard what we're going through as dr bauer put it is not easy as a community it's really hard um when some of us are have lost our loved ones um when some of us don't know if we're gonna have a job um some of us have had to move out of the district which i've also you know brought our numbers down so a lot of our children from alan
086rock who were with us a year ago are no longer with us and all those things have an impact um on us you know not just do we lose them physically but you know that that also um leads a space um behind and so anyways i i want to echo all the things that were said i know the committee um who was formed to uh to to do a tough job of recommending right um some hard recommendations to us i know they're doing their best i know it's not easy uh believe me as the leader right signing up for some of these things um it doesn't feel good all the time but it's things that we have to do in order to to push through and so um thank you all i also look forward
087to hearing from the recommendations based on your uh discussions as leaders from your specific relationship on that committee and also gathering information from the community as to what we should do and how we should do it and what schools um you know we should we should move forward in not easy definitely not easy but things that that we get to do um any leader can come up and and say yes and i when it's easy when we have extra money but it's the hardest times right that um at uh [Music] it's not easy and it's easier to just say i'm not gonna do it but we get to and so i look forward to having those hard conversations because that will push us forward and once we get through that hard time you know i
088i feel it'll it'll get easier so thank you again thank you to all the parents especially the new parents that have joined us tonight uh welcome and i'm glad that you're involved um here at least at the board level i know that you are involved in your child's life and you want the best for your children and so welcome and i look forward to continuing to hearing from you and i hope that you are able to connect with dr bauer um in order to make sure that you get your questions answered because it's very important that we all feel connected um listened to and heard so um thank you and with that i did see president yeah thank you i do apologize on my internet connection was cutting in and out when you were calling
089on me and i was trying to talk and i think i wasn't able to get through so i do apologize for the technical issues i just have some brief comments uh that i wanted to share and um you know these last few this last month has been incredibly trying uh due to things that uh many many things that are completely out of our control as a district we've had to take on uh the task of having to go and and step up for the the the the authority that is granted to us in the constitution the state of california and that's unfortunate um mayor le cardo has unleashed his his guerras on on school districts in san jose in the middle of attempting to reopen our schools and that is unconscionable it is unconscionable the
090fact that for uh the purposes of uh political gain there's been this all-out war on school districts and different fronts uh and with the use of a 501c4 a very very nebulous type of organization that are susceptible to dark money we've seen that in the past where arizona money has snuck in to affect the issues that are going on in california and the things that affect us here in our state and he's using that to to gain influence and to push his agenda and so it's very unfortunate it's very unfortunate um that we have we have the district are attempting to go ahead negotiate with our bargaining units to strategize on the best direction to move forward and we're having to watch our backs uh for this power grab from an individual that should be
091looking out to work in our best interests he's attempting to expand his authority which the the constitution state of california does not even expressly forbids mayors from getting involved in the governance of uh of local school districts and all the while we have uh a lot of things that are that are impacting our city that the mayor has direct authority and the direct ability to impact and to positively impact and yet they're going unaddressed and while we're attempting to open up our schools we see syringes all over the street because individuals have decided to go and uh set up in encampments right next to our schools they're uh you know we have we unfortunately have been receiving reports of constant break-ins from folks who've decided to make a certain part of our of our of
092our schools their their the place where they're residing and i completely understand times are difficult and tough um but our school should be a safe zone a location where our children shouldn't have to worry about those type of things they're walking to school and getting stuck by a needle on the floor we're talking about massive amounts uh and so with that i just wanted to express that to my colleagues i know that you've all been actively engaged in this broader conversation with other school board members i appreciate that for for not all of you but for the ones that who have stood up um my colleague with ranano corrina minfam um and our different times of course we've been engaged and um and so thank you for those who have stepped who stepped up um
093hello to the parents who've come into the meetings i really want to thank you this is a testament to democracy at work the structure of our government our local elected school boards here in open meetings that are agendas that are held usually around the second thursday of the month open to the public for people to come and engage and speak and participate something that you don't necessarily see at the charter schools that are all over the place even though they are required to abide by the brown act now but very rarely do they i've gone to their websites it's incredibly difficult to get access and you know try to get a hold of their board members here you have our contact information on our website and we are at your disposal because that's the way
094the system is set up so that we are available we are accountable and we're here for you something that we don't see in these privately operated publicly funded schools that are cropping up and have cropped up all over our district and uh and so just want to say thank you for being here and just wanted to make sure to remind everybody that this is a beautiful structure we have in place democracy you know the the worst except for the the rest of what whatever winston churchill said i love it because it uh it has uh the people's voice through your elected representatives here at work so thank you very much uh for being engaged thank you trustee uh trusty chalice i see your hand up i'm not sure from if it's from earlier and now
095you said you didn't want to speak you want to speak i never said i didn't want to speak i couldn't unmute myself but i i'm a mutant now can i speak now sure i'm glad okay so my trusty uh ernesto my colleague ernesto mentioned in the of the budget committee and if we i would like to ask if we can put something together uh say april first and get that going because a lot of people have a lot of questions from what i heard from the audience uh about the what's being spent what is it and maybe we can give them a little bit more information there um and if the cbo is not available maybe we can have the assistant or or send us some more information so that we can anybody who wants
096to inquire we can disseminate that information to them and also if trustee beran was willing to do april first if not we can talk after but um like i said before that i was waiting for the march uh figures to come in and to possibly have one april first uh if dr bauer can maybe schedule something going on zoom if not you know maybe i could do it uh we'll we'll see um and also i did want to ask one question because since everybody's mentioning um i guess money um i had i think i read somewhere and maybe this question could be directed to mr rogerio that we now have lower than 10 000 students should the trustees be getting a lower stipend and if so adjust and lower that stipend amount and if that
097could do be done as soon as possible because we're around the 8 000 range as far as ada uh go and should we be reducing that as well or should we wait till we're told to reduce it um if i can have him answer that please thank you just to tell us before he answers i know i know you asked dr brower something so we'll wait for dr bauer to answer at the end of your comment um but mr ruiz actually it'd probably be better if mr reese answered first because the other one yes so we're going to have mr ruiz we're going to have mr reece answer i just want to i don't want to miss any of your questions because they're very good questions so thank you for asking them just want to
098have dr bauer note there that we'll come back to her when you're done uh when we're done here mr royce can you please answer that for trustee chavez yes so the the education code does um it the the amount of board member compensation the monthly stipend is based on uh total ada of the district it's not a very straightforward calculation because it also has to take into account absences from a base year in years past so what i can do is i can prepare a summary of this and i can look at that very issue we did look at it about a year and a half or two years ago um but we can look we can look at that again and we can agendize it for the next board meeting and bring it back
099as well thank you thank you mr reese thank you trustee chavis any other comments before dr bauer responds thank you mr rogelio any other comments trustee thomas uh no i'm just looking forward to what dr bauer has to say and then i'll comment thank you uh she is what was your question can you repeat it because i know we went on to miss dr bauer so one of them was that if i had asked before during the uh budget meeting and that people were asking to have another budget meeting and and i didn't really want to have it and because the figures hadn't come in and mr covera the cbo of the district said that they were waiting on the march revisions and stuff so i said okay let's have it in april first so
100i'm asking if we can set up a zoom if that's okay with the other um board member because uh i i had asked at that meeting but uh didn't get confirmation so if dr bauer can tell me if the zoom meeting can be available through the district if not um if a trustee could just go ahead and have it and if she can have the cbo there to answer questions and all the uh information on some of the financials is and if mr povera cannot be there because he's very busy uh have his assistant or uh another staff member in the cbo's office attend before you answer dr bauer is this something that you checked with uh trustee carano about in schedule we spoke out about it at the last budget meeting okay i just
101uh i know that we typically schedule and i don't think dr bauer has ever said no we can't use a zoom but if you can answer that dr brown absolutely no we will work with trustee chavez as the chair of the committee to schedule the best time trustee chavez just to remind you that there is a local holiday uh the day before and i think it will be that's why i would like for you let me talk to you about the calendar uh you did ask uh to have a follow-up budget committee meeting in april so we were very aware of that and we will be ready but if if it's okay with you let's go ahead and just check calendars to be able to address and make sure that all the parents are available
102because that following week is spring break so just kind of you know to be on uh favor for everybody right that everybody is able to attend i know people say you know we're in a virtual world uh everybody's available all the time but out of respect to our families and their calendars i think it would be a good idea just to kind of check out the calendar we can do it as soon as we return from spring break and that way it allows for everybody to be you know to be here including teachers right in including other staff so with all due respect uh trustee um uh chavez the week of the 12th we can let the audience know that the week of the 12th we will be looking for a day and then that
103we will inform everybody about that meeting that would be perfect thank you all right and so uh trustee herrera i do wanna i forgot dr bauer before you continue i'm sorry i don't know trusty chavez had anything else to say in her were you done trustee chavez you are okay thank you i just want to make sure that you had all the time you needed okay okay thank you dr bauer i apologize for interrupting so i'm gonna ask the rest of the board we're gonna do this a little bit ahead of time because somebody's birthday is on monday and that's trusty herrera lo era has a birthday and we wanna wish her as a alum wrong family we want to wish you a fantastic birthday we hope that you have a fantastic time with your
104family and we are a family and you know i just want to celebrate that and and have have a great time i was about to start singing happy birthday but i got shocked thank you no i appreciate that thank you i appreciate the thought um and with that and a smile on my face and thinking of my mother martha herrera who gave me life i will go ahead and move on to item let me i thank you for uh i don't have a paper in me in front of me i'm trying to save paper so i'm using the computer so we'll go ahead and go on to item approve unrepresented management supervisory confidential employees one time off schedule for 2019 2020 and 2021 school years so for purposes of conversation and moving this item forward
105i will move to approve oh a second vice president can no seconds um we'll go ahead and open it up for public comment and then we'll come to uh trustee comments of questions uh mr moran [Music] um i know i just announced it so i know we have people who are going to be raising their hand do we have anybody from the audience who or the public who's raised their hand to give comment on this item yes we have at this time we have two people first one is anna robles okay welcome miss robles foreign are you available to translate i just want to make sure that she understands what item wrong okay so i'm going to go ahead and repeat it so she can hear so we're on item 501 approve unrepresented management supervisory
106confidential employees one time off schedule payments for 2019 2020 and 2021 school years uh i'm repeating it for miss robles and any other public uh members of the public wishing to address the board um that is the item that um we will be focusing on at this time okay it india is oh just a reminder thank you just a reminder um these meetings are posted ahead of time with the detachments um and i i'm happy to also meet as dr brower mentioned and i look forward to um sitting down with miss robles uh to answer her questions uh mr moran anybody else um from the public wanting to speak on this item yes we have brenda sandejas welcome back miss anders as soon as you begin speaking the timer will begin i just want to
107say today that i'm really disappointed to hear that uh teacher staff and unrepresentative employees will not be getting a raise in 2019 to 2020. we are living in unprecedented times and it's sad to see this i understand our district is at a deficit and can't afford that but i just want you guys to know the big sacrifice that employees had to do and they are not receiving a raise and a two thousand dollar check is only for full-time employees so part-time employees will be getting less and it's just really sad to see that there is a check to price the work that these employees have done and i think they deserve a raise is not okay that others get a raise and staff teachers and employees did not get a raise in 2019 to 2020.
108thank you miss sandejas uh mr moran anybody else no board president that's all uh dr bauer yeah and just for the last uh on item 8.02 is when it's going the rest of the staff is going to be addressed in terms of that one time only and teachers receive that in february and it was agendas just to clarify that everybody this is part of everybody's all the employees will be getting the same thing thank you thank you dr bauer um we are on item 501 um mr moran if there's nobody else from the public we'll go ahead and move to trustee commons or questions yeah there's no uh other hands thank you um at this time i'd like to open it up for trustees any questions or comments at this time trustee vegarano yes thank
109you uh board president so i um you know one of the things that i have been supportive of of dr bauer both as a parent um not on the board and and now on the board is and i really appreciate about her style is is you know that you could say she's a people person like that that's a phrase that we use and it's someone who you know who cares for their team who you know is trying to work with people and even evidenced by the fact that she's you know responding to the comments for a meeting and make herself making herself available as she has you know in the community and you know as far as i can remember for the many years i've been involved with the district so i appreciate that um
110and in addition you can't in my mind put a number on on or a value on the appreciation that i have for you know for our our principals and our vice principals and you know our district staff and everybody that that's worked as we've talked about this past year gone above and beyond like behind the scenes work that has happened is no one will ever know about it but we as board members see it and and it's amazing what this team has been able to do and so i do appreciate that um in terms of this you know dr bauer and i have i've had several questions with for dr bauer about this particular item well this one and the next one um and just trying to see if there's a way that i could
111um in my mind have this um you know it's difficult because i do want to recognize again the efforts and compensate the efforts for for our staff that have worked so hard but at the same time you know as has been mentioned and we all know it's very difficult times right now and you know it's when we're talking about having to bring our students back make things safe you know we've talked about mental the issues with mental health and you know i've had you know in my own personal you know life i've had a history of of having to deal with mental health you know issues with people close around me and so you know i understand the importance of all those things and it's just i'm you know it's difficult for me at this
112time especially with the unknowns of what it's going to take to reopen or repurpose or there's just so many variables out there that i i'm finding it hard in my mind to be able to justify at this time um you know the this this partic these particular two items 501 and 502. um you know i would i wish that we were in different times and i would love to to give this little boost of morale or support or whatever it is the good thing though is i think i did the math about 80 of those that would be impacted by this um i mean i know it's we live in a very challenging area but in my opinion it's not like a make or break thing like there i don't feel for the most part
113that the individuals impacted this by this would be you know extremely detrimentally impacted by if this were not to to go through tonight and so that's at least one thing that i'm comforted by is i think the majority about 80 percent of the people in my estimation would hopefully be okay with or without you know this item so i'm i'm not 100 decided i have heard public comment about this and i have my own thoughts about it as i've talked about but i'm interested in my colleagues positions but um you know i'm still weighing whether i'll support this tonight so that's all for now thank you any others have any comments questions for president yes vice president um yeah these are very difficult times we're making a bunch of very difficult decisions or possibly typical
114decisions in the future that we may have to take and you know we're we're dealt with this same thing of having to to [Music] uh get ready for for budget cuts at the same time still try to retain good qualified folks that keep our district running and so i just say that to make sure that the public is aware that while we have to prepare for significant cuts we at the same time still have to retain uh our our very high qualified and very committed personnel because that's the reality of it we are in a very difficult situation where folks can walk to another district get paid a lot more in an area that has more resources and the the reason that our teachers our you know all our staff everybody sticks around because they're
115committed to allen ruck um and so i i you know it's very difficult the easy thing would be to jump on board with folks and [Music] and say you know you know this is a it's a tough time so we're gonna forego uh any sort of compensation that would be the easiest thing uh but that what we have to do is make sure that we do keep our staff do we keep our personnel here continuing to serve our students and and that only is going to happen by providing the appropriate remuneration uh i ask us to look at ourselves and if you are given the opportunity to earn more in another place what would you do um and i'm not directing that to my colleague ernesto because he just spoke earlier i'm just saying that
116in general to all of us uh and i know that the answer would be we'd probably walk if uh if we didn't get uh the compensation that you know you work very hard for uh so you know as a board member um we'd have we have to take those very difficult decisions i think the board president mentioned that you know in easy times uh it's pretty cool you need to show up and make comments and stuff like that so you have the ability to spend money on cool things and stuff of that sort um it's these trying times that uh really test your leadership skills your ability to look beyond one little thing and engage in you know myopic type of leadership and instead you have to sit back and look at everything and realize
117that uh you're gonna have to make cuts you're gonna still have to keep people here and not not have them walk and you know people are going to be out there that won't understand and they may make you know comments that are not that are ill-informed you know whether intentional or or maybe because just they they don't know what they're talking about um and so those are the things that we have to deal with as board members so i say that uh to in part inform the public as well as encourage your colleagues to to consider that you know we have some good folks here let's make sure that we keep them here in the district and so those are my comments well sorry thank you uh vice president um i do see chavez i
118see your hand up um with you and i also see because go ahead and go to bed and i'm still collecting my thoughts thank you uh yeah so i appreciate that perspective that's really that's you know that's what i want to hear um so thank you trustee quintero and you know just to answer the hypothetical you know that's a very personal question for a lot of people you know if you have other opportunities do you take them i know in my life sometimes i have taken those opportunities and sometimes i haven't i've been content regardless of the financial opportunities just with the the job that i'm doing and like i say it's been the other way other times so so that's very personal um but it's good perspective and i appreciate that you bring that
119the other part that i just wanted to mention is i agree like we we've talked about this in the past when we you know we've we've given raises and done things like that we've talked about the importance of keeping staff and keeping consistency within the district a huge thing in school districts is consistency because it takes a long time to to be able to learn how to navigate through all these things and all these laws and rules and regulations and and so so that's important to keep staff teachers you know from top to bottom and bottom to top in the organization so i get that we want to pay people and compensate them in a way that would make them want to stay for this particular item however i think it's a little bit different
120because it's a one-time well two-time i guess if my understanding is correct which i believe it is um payment so it's not like we are it's not like this is something that would you know be part of the our salary that would continue ongoing and make them in in the future competitive the price or the the salaries competitive um with other districts or other opportunities and so that's that's just the the kind of opposite side of that that i think about is yes it's something that may in the short term incentivize people to stay but it's not salary it's not on schedule that would be something that would then you know bring them up to maybe some other area so so that's the piece i wanted to add thank you trustee thomas um do these
121workers deserve the pay um yes but just because they deserve it at this time should we do it i don't think so um and what i i do have a question uh for dr bauer but but how do you justify especially since we're in deficit spend deficit spending we need to reduce schools we need to lay off teachers would it be the wisest thing to give this one time off schedule payment being that the budget is is in deficit spending we have to cut do all these cuts um it doesn't seem nice to me at this time and what i wanted to ask dr bauer is out of what fund is this money going to be coming from uh can i get that answered by dr bauer and then i finish my comments please i'm
122going to ask mr chang is is the general fund uh trustee chavez we need to be careful with how we praise questions that's all i'm going to say okay maribel sorry and i know you have a question uh trusty chavez i just want to make sure you get it answered um mr chang can you help answer that yes good evening uh madam president um the answer yes yes it's from the uh general fund itself thank you mr chang i think uh dr bauer already answered it but um i guess i'll save my other questions for later thank you uh travis i don't think anybody has her hand up so unless anybody has their hand up if you want do you have any other questions for this item i'll i'll save my um whatever i have
123to say for later okay do you have any other comments for this specific item though or no then actually um both of the two trustees that spoke before um said a lot of what i was already going to say so i just don't want to repeat the same things uh to save time thank you thank you okay um and with that i just uh i also don't want to repeat a lot of the same things um and the only thing that i will add is um i know that i know you asked you know if if that will really make a difference and actually being a daughter of you know um i remember my my father getting like a 10 cent raise you know and what that meant for my family when i was you
124know a child um it meant a lot and that was 10 cents right 10 uh i remember those raises and how we would celebrate them um and of course the cost of living was very different you know back 30 years ago or so uh not to date me so much but you know fast forward i mean i think as you all mentioned you know do they deserve it absolutely um you know they've been working hard you know it's hard it's hard it's one of those tough tough decisions um and also i think of the cost of living and i think of the comments right from our community um you know we had a comment who was maybe talking on a different item but i know was talking about raises right um it's tough times for
125all and i know that any amount that um we'd be able to to raise or not raise but to give them on this one time would be very helpful um and so i plan to to support it you know um knowing that we have a lot of hard work coming our way uh to ensure that our children and our staff and our community continue to have what they need in order for our children to get the best education possible um and beccarano i see you have your hand up i don't know if you have anything else to say before we move on to voting yeah yeah i'll just i'll try to be quick again um so i i appreciate that as well you know that's you're right you know any little in this area in
126this time any little you know whatever infusion of of you know cash flow or one-time cash helps all of us but as just as i mentioned i think about 80 roughly about 80 of the people that would be impacted by this are roughly in the like 120 to 140 000 range i think that's public information um i believe and so i think my assumption is several of us as board members are in that range i know i am and so again as i would appreciate i would appreciate that amount of money but i as i mentioned i'm fortunate enough to be in a position similar that you know it given the bigger picture of everything else it would not make or break me um but i realize that every person's situation is individual to them
127but um i just wanted to bring that up that the majority of people impacted by this you know in a very expensive area are compensated i believe um for this time given the situation competitively um or at least in a position to continue living as they do now so that's it thank you thank you i'm seeing no other hands up we're going to move on to the vote i'll go ahead and go down um list trust us no trusty fam trustyfam if you cannot mute yourself we'll come back to you vice president quintero hi femme i and myself i three yes who knows um thank you we'll move on with item 502 consideration and approval for superintendents one time one-time off-schedule payments of 2000 for 2019 and 2000 for 2020 2021 school years i'll go
128ahead and open it up for uh public comments at this time and then we'll move on to uh trustees mr moran do we have anybody with their hand raised uh yes we do we have two people at this time first person is paul soto welcome mr soto as soon as you begin speaking the timer will begin uh good evening board members my name is paul soto i'm a 52 year old uh son of sassy sausage my father um picked fruit there in the 1930s 40s 50s and 60s grew up right there on the grounds of uh of guadalupe church and went to lee matson um i'm a bit concerned as to why these kinds of types of items are even agendized the um i i don't think it's any like wild guess that people are
129suffering in our city and we don't have any protections there in the school there's been historic problems with elimrock unified school district you know he saw herrera just i mean decimated the reputation of any chicanos um governing the and overseeing the educational system of our children and it's one thing to experience the oppression and the redlining policies and the discriminatory practices that are associated with redlining from the galacto but when these this type of mismanagement is going on and the board is filled with chicanos yeah i got i i really take exception to that i got i have a serious problem with that serious problem you know because this is this is shameful that this is happening this ain't on le cardo i'm not gonna put everything on on le cardo no i see what
130he's doing he's playing chess with the with the school grounds because he wants to monetize the real estate on them i get that part but there is a degree of responsibility that this board needs to make and agendizing these particular items and wasting the time when the real core issues with regard to the education of our children should be the primary objective and the primary goal of really any of the agendized items so i'm very very disappointed with what's been going on uh what i've been hearing today in the spotlight article that just got published thank you thank you mr soto any other members um uh yes we have usario the zoom as soon as you begin speaking the timer will begin hello okay i just want to make sure that you're ready to translate
131thank you okay thank you foreign anybody else from the public yes we have emma welcome miss tekba see give me that um yes we have karina welcome karina as soon as you begin speaking the timer will begin gracias madam president yes uh vice president um can i uh what through you may ask our general counsel a question sure um yeah madam president i would like to know the uh some of the callers had mentioned that they are they're from the washington school now alan rock has no schools by that name that i'm recall that i that i know maybe staff can confirm but i've lived here my entire life and i don't believe we have any washington schools i know that san jose unified has a school by the name of washington school and so
132my question is can we represent people in san jose unified i know the answer to that question but i'd like general counsel to explain to the public how our governance works here in uh you know under our school district system that way people can be better informed thank you mr ruiz thank you so this board is uh its jurisdiction is over the schools in your district and the students and staff members who are in your schools only you do not oversee or are responsible for other schools in other school districts or jurisdictions thank you appreciate that thank you thank you uh mr moran any other members of the public wishing to address the board at this time there are none okay with that we'll move on to trustees any questions or comments from the board
133um and trustee chavez we're going to start with trustee vicarano yeah i mean obviously i stated what i stated in the past item um you know i if my math is correct i think the the decision was to approve the decision to approve the last one is about 268 000 over the next two years um and so it would seem that for this item another 4 000 may not make that much of a difference but i still for the same principles um like not school principles but principles like values um i i would not be supporting this again reiterating my utmost respect for dr bauer and the work that that she's done with all of us and her and i have done together the same for school you know the previous item i'm i've done
134had a lot of positive experiences with all of those people but just on the grounds of the situation the financial situation the bigger picture i just um i can't support this item tonight thank you trustee trustee chavez um i echo what uh joseph herrano just said and also i just can't justify especially now anyone asking for this race knowing that the budget is in such bad shape and we have been in deficit spending overspending what we don't even have not only in the bank that we don't have in the bank accounts but spending on things that shouldn't be spent we need to be spending that money and allocating every resource towards the children's education and do these people deserve a raise i'm sure they do should we do it not at this time it just
135looks bad to the community if there will be a time where you can and you can justify doing such but at this time and closing schools it's just shameful thanks thank you any other members of the board wishing to make a comment or share any questions or ask any questions at this time okay with i i have a question and um maybe mr chang i know you're here um and you're where the budget and where money would come from i know uh trustee chavez asked on the previous uh question where that money would come from um so if you can just confirm that that it would be the same and then also an additional question question sorry i hear my echo let me meet you additional question as you're answering that also is is this
136i know we um approved for the teachers to receive a raise um and is this any different from that um that raise that we just approved recently uh the amount welcome mr ching you madam president can you hear me yes okay so um the the first i'll answer your last question first um in terms of is this um any different from what we have provided to other bargaining units and the answer is no so recall um you know we approved the board approved in february um the one-time payment for 2000 in 1920 and another 2 000 for 2021 for area members and also because teamster had a week 2 class teamster was approved in february as well csda was only approved for 1920 because the v2 claw has not taken effect yet until we negotiate
137their successor agreement but that item is on the board agenda for tonight for consideration as well so um a short answer is no the the the proposal is identical um in terms of what other bargaining units have received um in terms of the first question i do need some clarification um what the question was where is the money coming from yeah i know the answer previously was um from the general funds so just confirming yeah yeah and the same answer thank you okay i see uh trustee chavez and trustee branano's hands up go ahead trustee chavez and then we'll go and show him um i didn't approve a raise for anybody because i decided at that time that because the district's finances are so bad and that we're closing schools and we're going to be
138laying off teachers that this is not the time to give more payments out thank you you're trusting me yeah um i just i just i guess it's a question maybe for mr chang hope he still has his microphone on uh but i think i just want to make sure that we're careful if we need to be in terms of he keep hearing us talk about this as a raise but am i correct and thinking that's not technically a raise because i would my assumption is that a raise would be something that goes on the on the salary on the schedule and and becomes part of the ongoing payment so this would be a one-time i don't know what you would call it but it's not a raise i just want to make sure that we're
139using the correct phraseology here thank you trusted i know yes that's exactly what i wanted to make sure that so one time just like the teachers um and then i just also wanted to make one clarification the difference for me between the three percent or the the not the three percent i'm sorry the the 2000 that was has been negotiated for the teachers and you know all the other bargaining units and this one to me is just the the current salary schedule compensation and and i guess the ratio of this one-time payment versus what those staff members on their salary are already compensated at that's the difference for me um so mr chang if you can clarify that and then that's all i have thank you yes thank you um and you are correct this
140is not an ongoing race this is a one-time payment um for a negotiation session uh for the fiscal year 1920 and the current one 2021. so um these raises will not increase the salary schedule on an ongoing basis which is a positive thing in in in some ways because it's not an ongoing cost but it's a one-time payment yes it's a one-time payment thank you thank you board vice president quintero yes uh board president i want to thank uh i want to thank her colleague uh chavez for confirming and reminding us all that she did not support any remuneration for any of any of the bargaining units and so i you know appreciate you being honest and stepping up and speaking to that i'd like to speak to that as well and remind those folks
141that um you know there there are those of us who do have children in the district our kids are there we've seen good teachers leave and walk for other districts you know one year they were there really encouraging our kids making a difference and they got a better opportunity and so those that's the information that i take when i made those decisions to go ahead and support our teachers and while even though there's very difficult times i inform myself by the experiences that i'm observing at my children's school and knowing that to go ahead stand here and say i'm going to stand by my principles to to know um no no remuneration because times are tough it's taking a very myopic view and really really um hampering our our ability to keep uh our our
142personnel here at the district uh and so that's that's with regard to you know the previous actions that we've taken so thank you for uh being very honest about that thank you vote vice president uh trustee chavez i see that you have your hand up again is that yeah um from earlier okay you want to go ahead okay i want to thank him for um i want to tell him you're welcome but um i also want to say that i'm not saying that this can't be done later on down the road do they deserve it yes but like i said before it's not the appropriate time to do this and let us fix the budget let us fix um the closing of the schools and then six months down the road we can re-examine this
143but right now to do this right now it just doesn't seem right thanks thank you and with that um let's see uh board vice president quintero you have something to add no that was from last time okay just want to make sure i'm looking at all the hands and making sure i'm calling on you if i need to um okay with that we'll go ahead and move on to the vote at this time so i will call you as i see you on my screen uh trustee vicarano no trustee chavez that was on the last one okay move to approve um uh the let me read it make sure move to approve the consideration for superintendents one time off schedule payments of 2000 for 2019 2020 and 2000 for 2020 2021 school years anybody said
144one second okay we'll go back to the vote and my screen keeps changing here so here i go uh board vice president quintero hi uh trustee vacarano uh this time i vote no as well trustee pham hi chelsea chavez no and myself i passes okay moving on to item 503 board update regarding school reopenings in alan rock union school district dr bauer i'm going to be asking there's a team of fantastic administrators who are going that have a presentation on this and it's uh this item is only for information and you will be given a brief introduction and there will be a special board meeting where this is going to be further consider so i just want to make sure that the board is aware that this is not anything for you to approve it's
145just to know ahead of time uh the kind of work the committee has been doing and i'm going to be asking mr moran to lead the conversation thank you welcome back mr mona okay thank you dr bauer thank you board president so i have mr sarge putting this on the screen okay perfect so good evening board president nerada louetta board of trustees dr bauer and community this evening jason sorich our ed tech administrator maria martinez principal of adelante and i will present an update on school reopening tonight's update is to inform all stakeholders on the board about the work that has been underway to support school reopening we are preparing a plan for reopening to be considered by the board in the near future based on the santa clara county's designation from purple tear to
146red tier and the california department of public health deeming schools safe to reopen with safety protocols in place next slide uh jason yep um our reopening committee has been meeting every friday since the beginning of november members of the committee are listed here on this slide representatives from csea teamsters area as well as several site principals district administrators and dr bauer throughout our meetings we have discussed information from the state and county as information was constantly changing and or being updated discussions about reopening of schools in the future was obviously the main purpose of our work we knew that reopening of schools for our students would happen eventually we just didn't know when maria and jason will now share some details and responsibilities required of our district for the california public health department santa clara
147county and other agencies as was a timeline of events from the start of this pandemic to now maria hello good evening thank you for uh taking the time to hear what the reopening committee has been working on if i could get the next slide please or have we got my apologies did we go over that last slide yeah you could start right there maria okay perfect so the responsibility of the committee has um taken on several roles so first we've been seeking out stakeholder input through various methods such as town halls and surveys and in addition to that we've also worked on developing various tools to facilitate reopening all of these tools that are hyperlinked here in the presentation are also available on the alumrock website and there are different tools such as what the
148reopening plan looks like when we had created it uh initially for the beginning and the start of this school year uh there's also a draft handbook in place that we would be potentially utilizing to help guide our work in making sure things are safe and in place for our students and staff and we've also created a checklist that is for the campus and that was done through our work when we did walk-throughs of the school we also have um created a safe and smart reopening video with the help of students and administrators we also have done work around monitoring the health and safety guidelines essentially all of these health and safety guidelines is what is guiding the work that we're doing and we've conducted site visits um to elementary and middle schools to really understand
149what is needed in all of the areas of a school site such as the cafeteria classrooms and things like that next slide please so right now i'm gonna go over the timeline and the orders um and actions that we've implemented since the school closures uh started due to covid back in march 13th of 2020. so as we all remember a little more than or about a year ago we did have the school closures and we know that um there we had been initially told it was going to be for three weeks and so as a district we worked hard to make sure we addressed immediate needs such as making sure students have the devices they need the food accessibility and also the materials that they would need and later on throughout that last spring we
150were told that it would be distance learning for the remainder of the year so we continued as a committee and uh to plan for what a potential reopening in the fall would look like and so may through july of last year we worked to create potential scenarios for what it might look like in the fall uh we also uh worked to create teacher professional development because we knew that teachers were going to need to see different different things and apply different approaches in the classroom virtually and offered technology support next slide please and as we transitioned into the actual summer time we did come to an agreement for an mou for distance learning and as we progressed to start the school year off through distance learning in october through december the committee worked to ensure
151that care pods were being offered at sites that we were preparing for required state testing that would need to be held either at the sites or through virtual learning and also we had town halls to inform the public around um the health and safety uh precautions that were needing to be taken uh during at the time where kovid was spiking and so in november we know that there was an increase and there was a huge coveted spike and so we were moved to the purple tier where we were ineligible to reopen and um we did have our care pods closed up until it uh we felt that it was safe again to to resume them and then now we are here in march and there have been um laws and legislation passed uh senate bill
15286 and that agreement was reached to help and determine that california schools are safe for reopening so uh now we are looking at senate bill 86 to see uh what we can do to move things forward and jason is going to go ahead and chat about the reopening considerations all right so as you can see on this slide excuse me we're focusing on the reopening considerations for you know that are in front of us right now so uh first this you know this uh graph shows you or this chart shows you um actions and then our district response right so first off we had santa clara county declaring um that it was we it was our it was our turn to enable a safe return to face-to-face instruction so immediately we contacted and communicated several
153stakeholders including board president our bargaining units our planning committee and the principals next up was the approval of sb 86 by the state legislature so we got to work analyzing the content and the potential impact on our district we became familiar with the term to the greatest extent possible which will guide our work and we also consulted our district legal team there was an analysis of ab 86 and sb 86 conducted by the california county superintendent's educational services association following that analysis we set to work to interpret interpret what that legislation meant for our district again focusing on how we can make sure that we're doing things to the greatest extent possible to support students in the in the district and we also got to work collecting data to inform our our capacity finally we
154determined interest and feasibility of a face-to-face return this was done through through stakeholder input surveying community and staff you can see that we surveyed staff and family in march and we currently have a facilities survey uh underway at this point as well here's some of our next steps right so we are analyzing survey data you know as we speak we've sought input from family from staff from facilities we need to really determine uh the practical capacity and feasibility of what our what our return will look like we've been creating scenarios for face-to-face instruction those scenarios have you know have made us uh familiar with terms such as a hybrid model where we're focusing on synchronous and asynchronous instruction uh distance learning model uh and and there's other models um being discussed we're sorry about that
155we are planning for positive progressive school reacclimation for all students and the planning is is not done in isolation couldn't be done without a large stakeholder group so this entire process in fact the reason why we're presenting is we're presenting it as part of a team right so as part of that team we've been working to identify student needs uh prioritize the student groups and ultimately train our teachers and staff and then the next step would be to plan uh develop a plan to address and combat learning loss we recognize uh you know the tremendous stress that students are in so we want to make sure that we are developing a robust summer plan to truly meet their needs both academically and social emotionally and as i as i stated on the previous slide this
156couldn't be done without a true group effort so i really want to appreciate the efforts of of all of our groups listed here from the board of trustees to the allen rock families to our teachers and staff to our site administrators uh to the reopening committee which i'm humbled to be a part of and ultimately to our to our overall district leadership um and and with that uh that concludes our our presentation for tonight thank you so much uh trustees um any questions i'm sorry raise your hands i don't see any at this time and um being that it's not on uh we'll go ahead and move on we'll move on to public comment at this time for this item um remember i don't know man i don't know no i one thing i was
157going to ask is if we could take public comment first but i do have questions or comments too but i would like to hear a public comment but if you prefer before discussion now it's up to you okay we'll go ahead and open it up for a public comment mr moran is there anybody from the public who would like to address the board on this item yes board president at this time first person is paul soto welcome mr soto as soon as you begin speaking the timer will begin yes thank you paul soto from the horseshoe i would uh request testing within 10 days to get a baseline to assess the intellectual impact of covid on just get your baseline okay because you're really going to need that for future research secondly future sociologists are
158going to be in need of those numbers criminologists need these numbers as well and here's why because the the school to prison pipeline there is a causative relationship between lack of education economic issues that the child is experiencing and them ending up in prisons so what happens is that the mortgage companies in the auto loan companies are actually borrowing right now against these numbers of third and fourth graders because they know that there is a causative relationship not a correlation between the criminogenic uh conditions which that's what they call these conditions right now that's happening in the various on the east side these are criminogenic and what happens is that they assess how many beds they're going to need in the future based on these numbers now this is like one of the coldest hustles
159in in the world on how they monetize poverty and so the reason what my purpose here is is to inform you of the awesome responsibility that you have right now at this moment is to deal with these deficits i don't care about the financial deficit that people are experiencing in their pocketbooks i do however care about the intellectual in the emotional deficits that my fellow citizens and chicanos on the east side are going to be experiencing and so what my question to you as a as board members and and overseers of of these chicanos what are you going to do about it now i suggested made a few suggestions here and and i i really hope that you take it to heart because as somebody that's experienced that school to prison pipeline it ain't no
160joke thank you uh mr moran any other members of the public wishing to address the board and then just just before we continue i am experiencing unstable connections so board vice president quintero in case i get logged off you can jump in um any members of the public any others yes we have three more next person is brenda sendejas board president before we jump over to the next what was there uh i know that um there was a discussion about uh um and i had a step away so maybe it was brought up really quickly about um our outreach to our other government agencies to help us deal with reopening the circumstances that i spoke about earlier um was that already discussed like i said i had to walk away so why not bring that
161up right now if it is going to be discussed by staff so that it can inform the members of the public as they they make their comments um sure uh dr bauer would you like to inform us about a little bit about that before we go i know miss andreas thank you for uh being patient um we want to make sure we have all the information that we can get at this time um one of the major uh considerations for us in terms of safety for the kids and i really appreciate the comments from the the uh audience member before it's also um the safety of our students walking to their schools their sites and although things are looking a little bit better around our community there are a couple of sites that have um
162on house uh people you know to wave way close to the schools i check with other superintendents and the only other district who has similar issues is franklin mckinley and again it's not in all of our sites i drove around today to to see where some of the the issues lie and how can we support that we have also try to find new new places for uh these people right to to have a a better place to to set up their tents or their vans and things like that and some of them we don't have the authority to ask any of that but uh shepherd is of concern madsen is of concern and a little bit of fissure so those are the three and i'm wondering if that is what uh trustee quintero was asking
163about we i was going to recommend to the board that we needed to send a letter to the city so that they can assist us in addressing some of these concerns we have been i have sent multiple emails uh during the fall uh to be able to mitigate some of that presence but unfortunately you know very little has been done as i mentioned um uh as of last i i drove around last week i drive around every week to check on our sites but um last week we still have an issue had an issue uh today it looked a little bit better and i just wanted the board support um because usually i'm the one asking for for that but if the board considers that in which way you would like for me to to
164continue our advocacy to have safe sites specifically around the areas that i mentioned to you thank you thank you dr brower um and so just to respect the public comment we'll go back to public comment uh ms sandejas thank you for your patience um as soon as you begin speaking the timer will begin i am gorgeous and superintendent um president corina louera i have a couple questions um one of them is when did this committee meet and why hasn't this been accessible for the public um i've asked this i've emailed i haven't seen it on the air usd website there's no some link for the reopening committee i don't know how that was formed as well and how were these parents or community members elected um the second question i want to ask is has
165there been assumed curriculum implemented if this is going to be a choice for parents and staff that has been worked on so it can be a more smoother transition than it was previously also with the surveys i have a question i know that this has been a problem for alan rock to get all the surveys in and get everyone's input my suggestion would be to do a mail with reply um a hard copy uh to their homes mailed with reply surveys because i think that not everyone looks at parent square or emails and we need to do a better job reaching out to our parents and we need to have a log a log record on how many surveys have been turned in per school and make that accessible to the public so we can
166kind of see as well what is it that the parents um want and also a survey with staff a survey with staff i think should be priority and have that open communication with them because that is also something that has been lacking um and to quintero's comment about the unhealth around there i think it's a little bit insensitive to say that they're all drug addicts they say because they're serving there are unhoused families from elimra that are not all drug addicts and so we need to be careful when we label or we insinuate that they're all drug addicts they're not thank you uh mrs anybody else mr yes board president we have anna robles [Music] [Applause] gracias foreign that's it carmelina okay thank you uh trustee with harano just a quick clarifying statement i i
167don't know if i heard that correctly but i'm not currently the board president and i don't believe i had questions with regards to the where the money comes from so just wanted to clarify that thank you thank you uh mr moran sorry uh sorry mr method i know i cut the last part you want to repeat it sorry oh sorry yeah just the clarification if i heard the comment correctly that um i am not i think i was referred to as the president i'm not the president currently and um i don't believe that any of my questions were with regards to where the money came from for the last item something like that but i just wanted to clarify that uh i believe aronia thank you thank you going back to public comment mr moran
168any others from the public wish me to address us we have three more next person is veronica welcome veronica as soon as you begin speaking the timer will begin good afternoon um i also want to pick you back on the um questionnaire that was sent out today it's actually um really hard um because i had to actually read it maybe two to three times to actually find out that it's a link that i have to click within the letter to fill out the survey and not only that if you don't fill out the survey then you're opting out for continuing with distance learning and not being into the hybrid cohort so it is a little bit deceiving it was very deceiving for me um you know it was hard to like figure it out um
169so i definitely do want to make sure that if it can be reformatted or just a link and maybe i know it's very nicely professionally done in a in the letterhead but maybe something a lot more simpler for parents um to be able to go to the link and the questionnaire right away and they know what they're like beforehand just like quick like this is the survey if you want to opt in into the hybrid right um because i did find it a little bit hard to find it and then in the parent square like i said the letter you have to go to the attachment if you haven't done it yet you have to go to the attachment and then read it and then there's the link that tells you hyperlinked and then it
170takes you then so um it would be great to have something a lot simpler and something mailed out to parents because not everyone has access to um apparent square thank you thank you mr mona who do we have next yes we have karina welcome back karina as soon as you begin speaking the timer we'll begin a minute [Music] is thank you so much mr moran anybody else uh yes we have uh jacqueline montejano welcome mrs montejano as soon as you begin speaking the timer will begin thank you board president um good evening board of trustees and dr bauer i just feel compelled to share um as the shepherd middle school principal proud shepherd middle school principal on behalf of the shepherd community how much i appreciate hearing vice president quintero share his knowledge about the
171safety concerns on our site it just affirms that some of the work that has been done to communicate the need for safeguards for our schools are is making its way to the board um as the principal and i have experienced uh you know increased uh it's just it's a it's with a heavy heart as a society that we acknowledge um we have increased unhoused families and community members i have seen those encampments increase right across the school street from our school family family concerns about that have also increased because at the end of the day we feel responsible to provide a safe passage for our children to school and so every effort that we have made to create that safeguard has included um you know connecting with the city about the encampments and reporting graffiti
172and responding to fires and i know that district office staff has done face-to-face interventions um kind of to know of a to no end and um every action that has been done has resulted in no change and so it's really uh inspiring that it's a potential action that the board may take to unify around this and have a stronger voice to protect our children and provide a safe passage for children to come back to school thank you thank you mr moran any others no that's it mr moran uh there was somebody else who had their hand up like five times um but they put it up and they took it down so i'm assuming they probably don't understand they have to leave it up i've been observing the the hand raising while you've been calling
173on other people do you uh do you have a name and i can search yeah the name the name guadalupe gonzalez has been going on up and down like four or five times so i'm assuming they probably think they have to hit the raised hand and they'll be recognized okay i found her um i could allow her to speak now yeah let's go ahead and a new um guadalupe gonzalez um would you like to address the board at this time yes um do so as soon as you begin speaking welcome okay good evening my name is guadalupe gonzalez i'm here representing the mayfair community and in our community we have 12 schools and the amount of students and parents walking to school is really large right now we've been having issues since late february 2020
174with the homeless incumbent alongside the creek from the freeway in transat jackson avenue all the way to san antonio street where lim where lee matson is located we have physical assaults to residents sending them to ers at hospitals neighborhood devs from front yards car breakings and stolen cars illegal dumping of trash creating a glide zone numerous incumbents fires we go we get to a point we do not feel safe to walk around the block and we need to carry with us pepper spray for safety all of this is happening around the limax on campus my question to the board is what are your plans to protect our students and parents walking back and forth to schools and crossing the bridge at kramer i think the safety of our kids should be your first priority and
175right now is not safe for them with a dangerous environment you cannot openly medicine until is safe for all kids and that's what we as a community we demanding from you the border trust is for the alum rock to help us the community and work together to clean up this area to make safe for our kids to come back to school thank you um now um mr moran any other hands race that might have gone up again okay thank you um so now i'm gonna go ahead and open it up to our trustees um i see board vice president quinteto's hand up yes uh madam president i um i want to my i was addressed by name earlier and i i don't appreciate uh having individuals put words in my mouth the fact of the
176matter i could speak for myself and my comments were not intended to attack the unhoused i i completely um feel for those folks who are going through a very tough situation and i never mentioned that every individual out there is in uh unfortunately fallen victim to to this disease of drug addictedness what i did mention is that there are we have pictures of significant amounts of needles on the way to school and they happen to be dumped there by individuals who had encampments and so to go ahead and make those those uh those accusations are uncalled for and it's unacceptable um and so i i will not hold back and um and shy away from defending our kids the schools should be safe zones they should be kept free from individuals that aren't supposed to
177be on campus and i think that that's the position that every board member should take and not shy away from it to simply attempt to appease certain elements in the community that may try to pressure you i've been out there i've i've i've i've been out there pulling out buckets of unfortunate fecal matter out of uh coyote creek uh with when i was working with council member sponsors office getting down into the creeks and see what the situation is it's a tough situation it's it's really bad and it's a crisis that needs to be addressed by the appropriate authorities unfortunately we as a school district don't have the resources to deal with it but we do have the ability to speak on behalf of our children and demand that our children be kept safe and
178uh have a space where they can focus on learning and i have to stress about uh what's going on on their way to and from school those are my comments madam president thank you i see trustee pham and trustee de gerano we'll go ahead and go with mr pam okay thank you very much board president you know uh you know it was my you know i i was uh as the one responsible for putting this you know item on the agenda you know i want to thank the you know our reopening committee for you know for the work they have done you know uh secondly you know i i want to stress you know part of this but you know and i asked to put this on the agenda was a in response to mayor
179le cardo's continued reckless push to to reopen schools regardless of the situation and you know i you know i want to you know again you know re-emphasize that you know alum rock will reopen in a way that is best for our students families teachers and support staff you know i certainly want to take this opportunity to again you know to emphasize you know that you know our district should you know join the county of santa clara in uh you know lobbying for more vaccine doses to be allocated to our county and that's the only way that we can keep up this momentum uh and la you know and lastly you know that the situation has changed uh we are you know we see the light at the end of the tunnel but we're not quite
180there yet but uh you know uh ab-86 sp 86 has you know changed the situation where you know in you know in order to get funds you know our you know our district and many others uh are you know are thankfully in a position where we can start thinking about you know a safe reopening and i you know you know keep in mind that this is not a a full-blown reopening where you know we are not attempt you know this is not a a hail mary drive to the end zone but rather you know this sets us up you know you know and hopefully you know based upon the parent surveys and staff surveys we are able to craft that you know at a later time you know a very you know a very uh
181for lack of their term to use a scalpel instead of a meat cleaver to design a a soft reopening that allows us to meet the requirements of ab-86 sb 86 you know to the vulnerable populations that you know that would benefit from uh a return to some form of in-person learning while at the same time ensuring that you know we keep you know the majority of our students families and school teachers and staff safe so you know i certainly welcome public comment and you know and your input is very important as we you know embark on this uh you know uh very important issue that you know i certainly find myself about to make a very serious decision so soon in my tenure as a trustee of this district so you know let you know
182again plea let us know what your views are and you know let us move in a careful cautious and measured manner towards uh the pot of gold at the end of the rainbow thank you very much madam president thank you trustee from trustee yes thank you um first i just wanted to uh obviously thank the staff for the presentation and the hard work that they've continued to do from the beginning of this to move us in this direction and you know as we all know things change especially in the beginning but throughout particularly more recently things change very quickly and so to move a large organization in a particular direction is very difficult um but you know i want to thank our team for doing that secondly i want to thank um trustee quintero for
183all also for um bringing up the point that he brought up about the dangers um for our for our youth and also to the public um comment speaking more specifically to the matson area um you know when i when i ran for this position i had three main points one of them was the safety of our children and families and the decisions that i have made and continue to make are always with that in mind and so you know having been a part of a very proud member of the shepherd community for five years as my daughters went through there i know that um you know miss montejano and the shepherd team and community have consistently and constantly been on top of and very proactive trying to address the the multitude of issues there on
184rough and ready um and i know that having dropped off and picked up my daughters every single day for five years i know that it is a chronic problem so you know dr barr mentioned it does look kind of better um today and and i have seen over the passage of time i would assume this is similar mats in a fissure that things can improve but it is a chronic problem so it might look good one day and then the next day there's three you know new things on on the street or wherever it may be so so i do want to um acknowledge that that it is a chronic issue and those safety concerns like the needles that we have documentation of amongst other things it would be irresponsible for an elected person to
185not point those things out as a part of the reality we have to deal with the reality and obviously acknowledging the challenges of individuals who are unhoused but at the same time we need to call out those safety issues we're talking about safe reopening and this is all part of it and so um when in terms of this particular item and safety and and also part of the comments that we heard we are as a district doing what we can and doing as much as we can given our resources to advocate for that safety but as was mentioned already the we we have a limit to what we can do this appears as though the the next option that we would have is for the city to step in and be able to address some
186of these issues and has been mentioned there's a lot of there has been a lot of pressure on us to open to open quickly and and do things you know in a very in my estimation um um you know not as thoughtful as it would need to be processed and so if the city or individuals um you know who represent city entities are going to push that then my question might be [Music] would they would those entities at some point if something were to go to occur with regards to safety of our children be liable so for instance at shepherd i know that because of the the people who are camped there i have seen many times every morning and afternoons where students have to there's no room to walk on the sidewalk because of
187everything that's there they have to walk into the street large crowds of students in a street that doesn't have a stop sign it doesn't have you know speed people speed through there and everything so if that were to occur and the district has done everything that we could to try to address that would my question at that time would be would the city then become at some point liable for for what you know god forbid may happen at shepherd or matson or any of these sites these are not statements that are um you know indicative of what the reality is for those unfortunate who are unfortunately in that position right now to have to live there they're just a reality of the the safety concerns that we have and so you know this particular item
188just to finish up is with regards to the soft reopening um and i want uh i guess to i guess my point is i want it to be understood that we're doing everything that we can to advocate for that but at some point we don't need the city to be um against us in this process we need them to work with us on a process that we've already been working on for months and months and if they're not going to work with us then at some point the question would be are they liable for the repercussions of what may occur due to them not being able to dedicate their resources to these issues so that's all i have for now thank you thank you trustee belgiano and before we go to trustee chavez um just
189on that note i do want to i know dr bauer talked about a letter i'm in agreement i've been very vocal about you know not rushing and making sure that we open up our schools um safely all the wonderful things we've talked about right um and that we don't get pressured by um other members within the city or you know any other pressures around other than making sure that we open our schools safely um for everyone um so with that dr bauer um i know we talked to you mentioned a letter in regards to you know sending that to the city um i'm wondering if we can include maybe some of the um language that mr vegeta just mentioned you know in regards to and then i'm sure you would and already included but just
190to ensure that we include the safety of our children you know walking around that area um and i'm in agreement you know the city gets to manage what the city gets to manage and that's their area what they have jurisdiction over and they shouldn't be telling us right what to do and how to do it so honoring what the city does um you know and working closely with them and working in partnership i look forward to sending that letter for that reason to make sure that we open our schools in a safe manner and make sure that we address some of these concerns um with that trustee chavez do you have anything to say or ask at this time yes um as well as the other agencies should we be looking into and also sending
191letters to the sanitation department to the um the land that they're on since its city is it is it city or is it a pocket of the county and do we get because i know certain areas of alum rock are pockets and over there in that area uh since trustee vegeta says he lives in that area is that county or city can can you answer that question please where i live is city and i believe where shepherd is the city i think joseph george and curtin may be the ones that may fall within county jurisdiction but i'm not sure because we're close to the uh to the district office and we're county so like i said there is pockets and everyone who is responsible as far as the water district as far as the uh
192you know whose land it is and even if you could maybe start like uh start calling the neighbors because they're the first ones that see them on the scene they can alert the schools and you know it's just helping out everybody keeping out a watchful eye as well as if you have the neighborhood also sending letters can we you know also ask them to put in their input that it's just not the school district it's the whole neighborhoods around that are concerned and want this problem taken care of i'm just saying that the more the uh the more that are signing off on this and letting the council know as well as the sanitation department know maybe directly to the council we're not getting any results but what if we start count calling the sanitation
193department what if we start calling because later on it's going to plug up the sewers whatever they're doing if they just start dumping everything um what about uh the medical teams what about the firemen that have to go out there when they pass out and get sick uh from the covet or or just sick because they're malnutrition i mean all of the agencies should be working together should we also be sending something to them as well as the neighborhood that's it thanks thank you uh or vice president quintero just really quick a little um information all of our schools regardless if they're deep into the unincorporated areas are have been are part of the city so like half the street will be annexed and the and they'll grab the actual school so all of our
194schools are within city jurisdiction thank you uh trustee beccarano yeah also really quickly too first of all i didn't i did not know that so thank you trustee quintero for that um piece of knowledge um but the other thing i wanted to say um with regards to this particular issue is that um obviously the unhoused population is i mean we don't even need to say it's it's a bigger issue than what we're talking about here with our district um but i i believe as i was able to just quickly read the draft letter i think was sent this afternoon i believe it speaks in the letters where i saw it to like a buffer zone that we're requesting um around our schools that that the city would would look at and so just to make
195sure that we put this in context where our request is not but at least if what i saw in the letter it's not necessarily to you know solve quote-unquote homelessness but we're asking for a reasonable amount of resources and help in the zone specific to where our children and families are going to go if we're going to be able to truly safely open so and i think that's a wise approach because if we ask you know for the bigger huger problem to be solved obviously we want that but it's you know i think it's reasonable to ask for this zone that um directly impacts our students and families thank you trustee with helano for uh pointing that out for vice president sorry but i that was i haven't lowered my hand for a lesson there
196you go okay um any other uh see dr brower yes just to add to the conversation and remind the board i think i mentioned to you several times that i sent emails in the fall regarding medicine is probably the most critical part and as you saw there's a a community member that knows exactly what those families and the community goes um what happens in madison is that a lot of the people use the bathrooms in matson they break in so they and they break the fence and our staff are the ones that are cleaning that up so i have to be also mindful about our staff our custodians who are um who are you know uh in in in the front lines of this situation and um there is you know multiple break-ins um every
197weekend and so we have to go and and disinfect and and repair you know all of all of the the damage and the reason the county and the water district got i reached out to them with no response from the water district at all was because the county says well dr bauer the creek behind madison is part of the water district so i have been kind of you know kind of like moved from one place to another to and i'm trying to find kind of what trust each other says you know we're going to do this in collaboration this was about that and in uh echoing a little bit the person from mayfair who says you know we're just asking when is this going to be addressed and that's basically where we're at uh multiple
198emails to different entities multiple messages and and now that we're we're talking we're just beginning you know trying to figure out how do we do our soft reopening how do we make sure that our schools are safe in the past you know we were not into this mode because we didn't have code with 19. um covet 19 has changed completely because we all know that you know that's transmitted when people talk and that's why we wear masks right in a lot of a lot of that population unfortunately you know lack those the access to the services that they need so that is the reason that we're asking for this support and thank you you know i just wanted to clarify that we have tried multiple agencies and we're still kind of in the same situation
199thank you i also appreciate the staff you know the principal that spoke today this principle that's gone out to churches and collaborate to try to support our community members because we know it's hard for everybody and we get to keep our children safe um so with that um there's no other questions or comments um thank you again miss martinez mr moran for presenting we're working so hard um and i look forward to hearing back to what the parents you know are saying and the staff um in the surveys so i'm also taking notes of some of the feedback from our public you know in making sure that we have an equitable way of making sure that all of our parents have access to answering that so thank you again and we'll move on to the
200next item uh we have item we already did 504 so we'll move on to item 505. madam president did we give uh yes direction to choose staff to move forward with uh so submitting the letter using you know their discretion to to submit it since it's not a gen dive um was there any direction um i don't know if there was any formal direction so thank you for um stopping us before we move forward um so dr bauer or go ahead board vice president i would just assume that uh from our comments uh staff can ascertain what our desires are and you've provided a template so is that enough or did you can that serve as direction yeah that's it that was my question thank you so much uh trusty travis you have something done
201and to expedite it can we just like say who's in favor and just uh kind of like do a vote just to know whose names are going to be on there now uh are you talking when you say whose names on the letter are just saying like are you okay with your name there you know that's it it's not uh i'm not saying that we have to agendize it i'm just saying is it a like i give i'm i would give my i'm giving my consent to dr bauer when you send the letter please put my name on it that's what i'm saying okay thank you trust each other if we could do that this evening and let her know so that way it'll be done a little bit quicker yes feel free to put
202my name in um and i guess if any of you um have a problem with your name being on please let miss dr bauer know thank you trustee chavez i would need to see the letter just before i'm assuming i'm going to be okay but i just would want to make sure that you know it does actually reflect something that i'm comfortable signing on but i'm fairly confident it will yeah usually the superintendent just sends it out signed on behalf of the district by herself without the rest of us on their uh board president so that's the way i assumed it was going to proceed since we didn't have it agendized okay thank you dr bauer for doing that okay moving on to 505 uh the board will consider its position regarding draft city policy
203public quasi public facilities um mr pham i know you requested to put this on the agenda uh yes uh thank you madam board president uh you know in regards to that you know uh just to give the community a background or i um you know members of this board attended uh meetings with the mayor and planning staff and our counterparts from the other school districts uh i believe in the last week of february and you know there are certain issues that came up uh as it regards to uh how the how this change in city land use planning would affect the uh financial future of our district uh you know just to say you know this is a gross overreach of you know uh the city's authority uh you know as a school district we
204you know we are governed by state law so it is very disconcerting that the city of san jose has decided to wade into waters that it traditionally does not have a responsibility for and seeking in many ways to uh govern the use of you know surplus school property you know as you know as it pertains to our ability to [Music] uh maintain a revenue stream that will allow us to continue on with our mission to provide an education uh for the alum rock community so you know it is with that concern that i bring you know i ask that this item be placed on the agenda tonight for discussion because it is important for us as a district to you know take a position so that we we posit so that you know should something
205come down the line we are in you know we are able to take whatever legal actions uh that are necessary in order to preserve the the financial future of our district as well as to ensure that you know we are in a position to continue educating uh the children of allen walk thank you very much thank you mr fam um with that uh board vice president quintero you want to add something to that um you know what i'll speak after public comments i know uh mr fam um you're requesting to for the board to consider its position regarding draft city policy um well this item are you uh is this on for a vote uh well well and are you are you um oh i'm not like to make a motion well to continue discussion
206oh uh you know what i would make uh this uh you know i you know for the purposes to continue discussion yes i will make the the motion but the you know but i you know originally i had hoped that we we could take a vote tonight but i think that uh you know based upon you know advice you know after speaking with the superintendent you know uh we we could give general direction now so that uh district staff could uh produce a resolution for us to to vote that would have been uh reviewed by uh our our general counsel regalia ruiz you know just to ensure that we are on uh you know a solid legal basis before we act okay if that's the motion i'll second it okay thank you uh both mr
207our trusty fam and for vice president quintero um with that i'll go ahead and open it up for a public comment at this time um mr moran do we have anyone on public comment who would like to address the board yes we do we have paul soto welcome mr soto as soon as you begin speaking the timer will begin uh thank you paul soto from the horseshoe um i really like the way that uh the senora just framed what is happening in our city you know if you play chess you can see the moves that are being made and one of the things that we learned from the chicano movement and from the uh lemon grove incident that involved the schools from mendez versus westminster from border brown versus board of education and from sofia
208mendoza at roosevelt high school and lincoln and garfield in in los easlos what we learned is that there is power in our body and that body can exercise that by refusing to participate in the system that is constantly generationally exploiting the chicano and i think that this if there ever was a time in san jose history to exercise that power it's now you can advocate to refuse to go to school you have the power in your body to advocate that you know what i am going to refuse to continue to participate in a system and participate in my own demise by allowing my body to be counted for pay don't allow the kids to go to school strike well god this is this is what we have been taught okay and i think that we've
209gotten soft you know throughout the throughout the years and and not really exercising that power i think it's time i think it's time to start striking to start every single chicano every single mexicano put down their construction tools put down the cooking utensils put down the senoras inside the uh cleaning the inside these cobit hotels and refuse these kids going to school and then let's see what the system does thank you thank you mr soso anybody else mr moran no that's all board president thank you um mr quintero i see your hand up yeah i want to thank my colleague uh board member uh min pham for bringing forward this item um i am completely in agreement with your comments i think that we as a board have to take action and express our uh
210the sentiment of the board uh in very very strong you know terms as strongly as possible while you know keeping and maintaining her professionalism and i would ask that uh you know in your motion that you include a time frame have that letter be drafted and you know the sooner the better so you know if you would be able to amend and add some sort of a timeline uh to that i would really be appreciative of it because i think it's urgent that we demonstrate uh to the council um the position of the of of our body because they're going to be taking action on things involving these issues sometime soon so i would ask that you you know possibly reconsider the language of your motion to include a time frame that you know makes
211it sooner rather later what's your fault oh yeah so in in response the board vice president yes i i would be happy and you know i will go and amend the motion to include a uh you know a timeline for district staff to draft a resolution and to have it reviewed by general counsel uh so that that leads me in order to do that um question to the superintendent uh you know uh how soon could this be done you know if time is of the essence could we possibly you know include this as part of in the special meeting later in the month or you know something you know but no later than you know then the and then the board meeting scheduled for april i think we can and i just wanted to rogelio
212um if we're going to have the special board meeting mr freeze can we add this item to be considered by the war on march 23rd uh yes that would be fine and i would only add that the city has indicated that they intend uh their draft policy to be presented to the planning commission and council for consideration beginning in may so with it we are very we we are in a crunch for time so i would say the special meeting in this month or the regular meeting next month just a quick question there was an email that came from the the city representative this afternoon does does that they gave a time frame that i thought i read again this was like a few minutes before the board meeting but i thought i saw something
213about september that they were pushing things back based on feedback or something like that that could well be so i i have not seen that it came in just like in the late afternoon and i believe it believe it could be wrong again because i just saw it just prior to the meeting if i may chime in go ahead uh board president uh yes mr chang go ahead i did receive an email um that was shared by the county cbo and uh from staff notifying um district representative that the timeline is going to be delayed um they're going to take up this issue sometime in the fall they didn't or note a a month but they are pushing it a little down the road thank you so could i know any others before we move
214on no that was all thank you okay uh yes um uh dr barr i'm sorry were you gonna say something else or i was just gonna uh ask the board in terms of timeline because i haven't seen that email either but um if this has been delayed till september we can bring this in the april right and just for the board to consider and if there are any you know uh and and that was kind of my my request from the board if that's an okay timeline before we get involved in other stuff because sometimes that's what happens yeah mr famine uh board vice president quintero so if that is the case then you know then yes you know i would uh amend my my motion to direct the district staff to draft the resolution
215you know in opposition to uh the proposed general plan amendment and to have it reviewed by general counsel uh for the um board meetings scheduled for april as the second or i concur thank you trustee travis you have a comment or a question i mean i still had some too just just that one i think the sooner the better um i know they mentioned march 23rd but it's up to the board thank you trustee with hirano yeah um i just i also wanted to thank uh trustee fam for bringing this i think it is important that we that we do take a solid firm stance as a district for me there's a lot about this that has been um disappointing discouraging frankly i feel it as insulting um personally and as a representative here of
216this district i think it's in us an affront to our um you know ourselves as board members the district but also to the voters of this district you know who put the individuals here well four of us and then we appointed through a you know through a process our fifth colleague but i think you know we we have had thirteen thousand something members of our community vote and nine thousand and six seven thousand like large numbers of voters in this community have voted for their representatives to to make decisions about things directly related to education the education in this community and so you know to pawn that off and and to just think that some other entity could come in and and take away our you know our sovereignty or or whatever you word you
217want to use here um is just you know it's unacceptable to me and and i am strongly in support of of taking this stance i think individually all or most of us have gone to these meetings and made it very clear where we stand kind of shoulder to shoulder with many other districts but this this official consolidated um uh you know direct communication i think is important as well thank you trustee i see three hands up and i just wanna make sure i'm not missing anyone if that was from before no no no that was before okay uh so i'm in agreement um i think we definitely need to take a stand and come uh united you know um in our response to the city as a board uh i know many of us have
218gone um if not all of us to all the meetings that they've provided and advocated on behalf of our our district here and so if i'm understanding correctly uh we are directing staff to draft a resolution and bring it back in april so there's no voting tonight correct okay all right thank you so much dr brower for bringing that back in april well there was a motion in a second yeah so that's why i wanted to provide that i was understanding correctly so we can go ahead and take act you know if it's so what is the action i just want to make sure i think we were it's for action so the action was to from the motion that uh a board member fan made was to direct staff to come up with a
219resolution and have it ready for the next war meeting in april that way we memorialize it and make it a formal direction to staff if we just take a vote sure uh mr pam do you have anything else to add to that yes so i i concur with the uh board vice president quintero and then i just wanted to close by saying you know it you know uh you know it is a a sad situation when the mayor of san jose you know decides to unilaterally uh you know ignore you know not just the elective representatives of this of this board of this district but also the 15 other school districts in san jose this you know uh you know as a former legislative aide this is you know this is a you know uh
220between this and and the mayor's push to reopen the schools this you know this is a this is an example of you know heavy-handed government i'll just say that you know of the of the worst kind you know where someone is attempting to you know ram their agenda down the throats of uh others and you know do it in a way where you know we're not able to to [Music] fight back so you know i i you know i certainly hope that you know we you know when when we revisit this in april you know we are we have a formal resolution legally vetted uh that will you know express the the will of this this school district you know and to to what let the city formally know that you know uh you know
221that this this type of uh municipal governments is uh unacceptable thank you very much thank you mr from so with that we'll go ahead and take a vote as i see you on the on my screen uh trustee varano hi trustee chavez hi or vice president quintero hi trusty fam i and myself i thank you now moving on to item 506 the board will select two board members to participate in the strategic planning committee so at this time this will open it up for any of the trustees that are interested in being a part of the uh planning committee um uh yes i i am interested um i don't know if in the interest of time i won't say anything beyond i'm interested okay uh yeah i was just i'm i was trying to be
222creative to see how we were going to do this right so first to hear the interest so trustee vegeta and then i see trustee chubb is your hand up yes i'm also interested trustee chavez is interested anybody else i also know that both trustee chavez and trustee haran are very busy with the budget committees um i wonder too if uh the board um if you're all open for nominations um i'd like to see mr pham you know maybe um being that uh he doesn't have a um a current um position within the board that maybe mr pham if you're open to being one of the possible board members one of the two uh okay but if you're not interested it's okay too to say no i'm actually interested so if you say no it's okay
223okay i i'm declining this time okay uh trustee chavez do you have something else to add i see a hand up i just want to make sure i'm not missing oops i'm sorry i just want to make sure i acknowledge everybody on the board okay um so with that i hear trustee chavez trustee vacarano and myself um interested um any suggestions as to how we should move forward i don't have a suggestion i just have a comment uh that i think it's important this particular position at this time obviously because of all of the things that are there's like 50 balls up in the air right now that we need to be strategic about and so um whoever is selected i think it is important that that this election occurs maybe not necessarily just because
224of who's available or not but i think we need to be thoughtful and see you know maybe all of us have our own strengths and experiences and we can bring that to offer that to the board and i believe you know some of the i know some of the experience that i've had professionally and and in other things that i've done in commissions and stuff has has given me a lot of experience in in the strategic planning area so you know i'm confident in my abilities but i'm also comfortable with all of my colleagues as well as i mentioned we all have strengths but i just want to make sure that that we think about this in a way that we look at you know who may bring the skill set that we need for
225this particularly given the situation that we're in right now so that's all i wanted to say thank you uh i know board vice president quintero you have something to say and then we'll go to trustee chavez uh no it looks like the nominations are there so if we were to take a vote on on individual nominees i guess we could see who has the highest number of votes and move that way okay thank you trustee chavez let's just vote okay so i guess we'll go name by name and then just take a vote unless we all send our vote our two names to dr bauer and then she announces later which way open yeah open person by person okay let's start so um trustee vacarano um i guess we'll go ahead and uh take a
226vote and whoever has a majority of the votes at the end the top two will then be um on the strategic planning so we'll start with trustee veterano um aye trustee chavez hi or vice president quintero hi trustee femme i and myself i okay and then we'll go to trustee chavez um trusty vegarano i'm gonna i should pull up chavez and tell you to move on to the next person for now i'm not but i'll vote right now and i'll go with the nay on this one uh trustee chavez hi trustee uh quintero uh trusty pam nay okay uh moving on to uh myself did you do your vote for trustee chavez oh uh nay sorry thank you and now it's me for for you for you yes so trust me for myself i uh
227trustee chavez no trustee quinteno aye trustee phem aye okay thank you so trustworthy and myself and i'm sure we'll get more information later as to meeting dates etc what that means uh thank you we'll go ahead and move on to item 507 board will consider board policy 3311. do we have to take a formal motion uh to appoint you both okay good one yes you may want to ask the general counsel uh general counsel so i i understood those that process you just finished to select the two members but it wouldn't it wouldn't hurt to have a another motion to clarify it or to make it clear uh based on the votes i move that we appoint uh board president carina and board clerk ernesto barrano to the strategic planning committee nice second to vote
228okay so um public comment before we move forward is that correct i was i was going fast i just want to make sure um yes yes right okay um mr moran do we have any members of the public wishing to address the board yes we do we have brenda sindejas welcome back miss andegas as soon as you begin speaking the timer will begin i just have a comment over this i just noticed that um there is this energy always negative towards linda and i'm just catching up to it and i don't appreciate that you guys always want to keep her out or not give her the space and i think it would have been nice to have a hedano give his seat to two ladies to women that could possibly have been a strong force
229to this committee i know that sometimes we want to speak of everything that we have on the table or what we have but giving it to two women to lead i think would have been a good idea and um i think they would have done a wonderful job i trust that corina will lead with grace how she's been leading these board meetings um that's my comment thank you miss and that has mr ronan do we have anybody else from the public wishing to address it for uh no no one else thank you so much um with that we'll go ahead and move to the votes trustee de carano hi trustee chavez we gonna mute yourself hi thank you uh board vice president quintero hi trustee pam i and myself i thank you okay now uh
230moving on to 507 um do we have uh somebody presenting on that dr bauer or is that yeah i'll be speaking to um thank you so uh board uh board president uh members of the board uh do appreciate the opportunity uh for allowing me to present uh this resolution that is coming before us that will eventually uh become part of our administrative regulations and board policies and stuff of that sort uh and so this is the initial step so appreciate the work with dr bauer as well as a general counsel to make sure that we came up with a resolution and language that would go ahead and stand the test of any challenges that might be put before us the idea behind this resolution is that at some point in time if in fact this
231board decides to move forward with an energy service contract basically things that the general public would understand is solar panels that we would go ahead and have in place policies that ensure that we have several things already in effect at alam rock and that we make sure that we have people who are qualified to do the job and it's people that are properly licensed and they're doing the right thing that um that we have individuals who are going through state approved apprenticeship programs because there's a lot of talk about hey let's go ahead and have people go and join the trades so they can get a job and there's no apprenticeships for them to actually get into the field and so i'm not saying that there isn't but the idea here is to make sure
232that we are stepping up and creating the space for people uh to be able to get into this field of of the of the the traits and uh more importantly here is the section that uh requires uh the this the contractors that do do the work for alan rock to set aside a certain number of spots for individuals that reside within our district and so the way that these things go is that the bond money that is raised to go ahead and pay for things such as solar programs and stuff that sort of construction um is derived from taxpayers in our district in alam and so it's important to make sure that those tax dollars recirculate back into our community uh and that's the intention here with this with this uh proposal as part of
233the process of developing the policy um general counsel was uh was very very um you know making sure that we crossed that we all about say crossed our eyes and dotted our keys but that we um crossed our t's and dot our eyes and um and so uh we did just that going out there and doing the research and so behind a policy that sets aside a certain amount of spots in a particular project there has to be a justification because it has to stand you know the very very strict legal you know scrutiny and so those are the type of things that we went out there and looked for you can't just willy-nilly say hey i want to do this because i feel good there has to be a reason and and the reasoning
234behind our desire to go ahead and make sure that one out of every four uh people on these projects coming out that would come out of alumrock from our district from zip codes that are in our district is due to the following uh based on uh you information from the u.s census and in particular from the american community survey which is a survey that comes out to uh the population that does obviously it's not as extensive as the census itself but it still is very very extensive and it pulls out uh key information from from all over the united states and so from that uh i was able to go ahead and determine that children in deep poverty in allen rock school district in particular um are at 10 percent whereas in our neighboring districts
235even in san jose unified evergreen other places we're looking at a three percent level of deep poverty for children in those areas obviously those children come from homes within our district and so it would behoove us to make sure that those families have access to good paying jobs possibly in the trades such as those 25 percent that we would set aside from these projects the median family income in alum rock from the american community survey uh shows us clearly the disparity that exists and so when i make comments like i did in the previous meeting we were talking about the situation faced by people here in alamo rock is incredibly different than in other places in the county which i i factor in things like this data that shows that in an alum rock and
236this is old information all right it's not old old but it's older information pre-covet and we're looking at 62 000 the median family income here in elm rock in comparison to 133k for the county as a whole i say well that county incorporates palo alto so it probably skews the numbers way off and you're right it does bump it up quite a bit but it's only by ten thousand dollars uh berryessa for example is at 122. double what alan rock is and i'm not doing this to knock on anybody for any community for doing well for themselves but it's just to illustrate the fact that we have some significant differences in income between alum rock and even our neighboring districts evergreen is at 150 k um san jose unified has a median income of 120
237123 000 as well based on this american community survey information now mind you this is all pre-coped so those numbers have drastically changed and not for the better um with many of our families being out of work uh being affected adversely because of cobit and so those are some of the some of the data and other more other information children with uh without secure parental employment um the percentage spikes up here in alum rock uh to 37 percent or nearly whereas uh county-wide it's hovering at so you know it's not good in any instance in both instances but it's a heck of a lot higher here in elm rock and it's based on that data uh that um this resolution is coming to you so that we can go ahead and take our you know
238wherever it is that we have authority to do something that we can go ahead and help our community recirculate their own tax dollars so that it's generating jobs and it's coming back into our own community and so with that said i would ask uh on the opportunity or if i can make a motion i would like to make a motion for uh for approval when it's appropriate madam president i think this is the perfect time i'll make that motion for approval second second by trustee veterano um and we'll go ahead and open it up for public comments and then we'll go to trustee commons and questions um mr moran do we have any members of the public wishing to speak on this item yes we do we have two people the first person is josue
239garcia welcome mr garcia as soon as you begin speaking the timer will begin thank you madam president herrera attractive hours and members of the board uh thank you for the opportunity to speak before you tonight uh first i would like to point out as mrs uh vice president quintero mentioned this is not approving any project this is just to approve the policy and a policy intends to create the following a level playing field where all contractors will play by the same rules which is very important it will provide employment opportunities for local residents and just to put things in perspective on city of san jose funded projects like libraries fire stations etc only 25 of the workers construction workers are from the city of san jose that means that 75 of the workers come from
240out of the area uh i don't think that is acceptable since we pay our own taxes we should put local people to work that doesn't mean that we don't want people to come from other areas we just it just means that we need to take care of our own if we don't no other district will take care of our families the policy will create apprenticeship opportunities there are plenty of people trying to get into the trades and obviously we need to have for us to provide opportunities we need to have that jobs and this will create um a lot of work for uh high school graduates and other people trying to get on into the um that trades which is a which these are good paying jobs uh the policy will require that uh all
241the journey level workers will be certified by the state on the electrical section and very important that it will create uh that it will uh require contractors to pay the prevailing wage which is a waste needed in our in uh for our community and as you know we are being hard hit with with a kobe 19 and for us the working class when we are economically hard hit it takes months if not years to recover so my time is up but thank you so much thank you any other members of the public mr moran yes we have brenda sendejas welcome back miss anders as soon as you begin speaking the timer will begin um i just want to say appreciate the effort of this um i support prevailing wages and opportunities for our younger generation
242especially a lot of students who opt out of college to go to trade school and this will be a great benefit to our community i have some questions i saw specific zip codes um and i have one question so does this override a bidding process or does this just tag to a bidding process of requirements for these bidders right according to these zip codes and my question is if this zip code let's say 95 95127 the company has a contract let's just say ng right ng solar panel um which is not local i'm not saying this is just an example and it's not a local company is there specific requirements that these companies have to provide uh local services in case that they do have contracts with an outside um company that's not in these
243difficulties how would that play an effect and does this limit the amount of bids we get in as a district again i support local employment and i always will but these are just some questions that i have to ensure that everything is equitable thank you any other members of the public mr monon uh no more okay thank you um now moving on to trustee um comments or questions mr behranano yes thank you um so i want to thank my colleague vice president quintero for bringing this um to us i see this as basically has been outlining his comments and some of the public comment comment as an investment in our community and i think one of the things that's that's key to what mr trustee quintero said is where we have the authority or the
244or the power to exert some some influence that would um you know that benefits our constituents and our residents we should do so and i think this is the case you know as the person who's who has brought previously this solar item to the board and continues to advocate for that i see that again as an investment in our community the savings that would be realized by a program like this is an investment in these bigger budgetary issues that we've been talking about for months now and so wherever we have the ability as board members to make decisions that our investments for our taxpayers here that who put us in these positions i think we should do so and so i definitely will will be supporting this as a hopeful um you know partner with
245with a motion that may come in the future for an actual uh solar program um and i thank again trustee quintero for bringing this thank you trustee vacarano uh trusty fun yes i too would like to thank uh board vice president quintero for bringing this up on the agenda you know uh you know career technical education was something very dear to me in my legislative service uh you know it is one of the you know great levelers for you know uh for for those who you know you know who struggle with college uh you know this the a career in the skilled trades provides uh well-paying secure job opportunities that can't be outsourced uh you know at the same time leaving the door open for additional education uh you know as life circumstances permit uh
246also you know uh this is an example of a power of a a local community run school district i mean you're not going to see this from from the charter schools or the private schools you know uh the you know these are you know the um these are the families we serve and if we we're in a position where we can reinvest in these families i certainly think that you know it's incumbent on us to do so so on you know so i uh you know so i am in support of the measure and i urge my colleagues to cast a knife out thank you trusty fam any other comments or questions before uh trustee chavez uh yeah um i see that where what was mentioned there but what wasn't i i would like a
247little bit of background if i can when the district applied and got the money and the plan was put in place uh to pay it off uh and it didn't get paid off can we see that documentation after i'm requesting that and the reasons for it not being paid off um and to me it's like this is like two things in one if it would have just been that we are committed to fiscal solvency that's one thing but another thing is that when we're gonna only get one bid from one energy company because this board has not seen three um and the way the solar thing was handled the fact that we were just gonna go with that one contractor and we haven't even seen other bids or uh it's changed since they first did
248the their estimates and since we didn't see the other three i would like to also see later down the line that they're b3 so this doesn't become another deltera down the line for the next board or boards um that's all thank you that was uh trustee travis uh go ahead um trustee quintero yeah um yeah madam president uh as he make as the author of this policy that is before us there i just want to make sure that we're clear that this has nothing to do with there was mention of money there was contracts this is simply a policy and in the past in the preparation of any possible action that we might take with regard to energy service contracts so there's absolutely nothing right now um this is simply making doing things like for
249example that uh any um sort of agreements that were entered um that it shall include not less than 25 percent of the labor employed or contracted to perform the the project work including subcontracted or subcontract subcontracted and subcontracted labor shall be persons residing within the within or the surrounding territorial jurisdiction of the district um and so it's basically elim rock or you know the zip codes that are within alum rock but might be slightly outside just to give us that buffer to have more people as a pool of people that can be part of this [Music] part of the 25 percent so there's absolutely no contracts or any money attached to this policy it's simply a policy a standalone policy thank you trustee um i see a couple different hands so i'm going to go
250as i see them trusty vegano yeah thank you i i was going to just say what um basically what trustee quintero said but i do want to make a clarification for possible future reference that i think i appreciate trusty trusty chavez's comments however i think they're at least partially if not um just flattered out inaccurate um i think i know that mr ruiz our our legal counsel gave us a a history and a presentation on the bidding process with regards to ng never has there been any commitment made or anything that was referred to again this item is not about that but i just want to make sure that in the future should we need to maybe mr ruiz will be able to review that presentation that described you know everything as it pertains to
251the bidding process and requirements and the history of it and those things so but i mean the this is a separate um item separate from that connected but separate okay thank you trustee my request was to see the documentation how come it didn't get paid off that's what my request was and and it wasn't inaccurate in saying that we didn't see three bids that was accurate thank you that's inaccurate but what did what did you not what are we talking about being paid off just for yeah if you can be clear in regards to this item what the what that means um say that again in regards to the item we're discussing your question is about getting paid i want to i'm not understanding your question in relation to the item where what was paid
252what did he talk about okay does dr bauer unders dr bauer do you understand my question i'm sorry chavez you you keep asking you keep saying was this paid off and i don't know what you're referring to what was okay when the district applied and got the money correct what money i don't know this has nothing to do with prop 39 if that is your understanding has nothing to do with that okay when they got the money for the cops this is mentioned in here right no it has to be paid back okay but this is a different this is a board policy about the process the district will follow uh trustee chavez there is nothing to do with cops has nothing to do with any contract that's why i'm i'm puzzled okay so this
253is saying that we have to be committed to fiscal solvency right are you are you in item 507 um okay i'm sorry i'm off i took a break real quick a bio break and i came back and i'm on the wrong number so what number are we on thank you 507. okay thank you okay um any other members at this animal trustee chavez uh catches up a little bit um i just want to thank mr quintero for bringing this up uh mr pham i know you some of the things that you mentioned i just want to highlight that it's important to support our our families of our communities right and so um our actions with our you know votes speak louder than any words we can say out there um we know that our families
254are hurting we know that some are losing their jobs so it's just ensuring continuing to ensure that our families continue to have jobs and continue to have be able to support their homes and all the wonderful things that happen when when our community when we're housed and we have a job and income coming in so i will be supporting this if i don't see any other questions or comments i know trustee chavez i want to give you some time if i don't see any others then we'll move on to the vote okay seeing none we'll go ahead and move to the vote trustee vegarano hi trustee chavez i'll come back to you at the end trustee pham aye board vice president quintero hi myself i trustee chavez hi thank you passes and at this time
255i would like to request um for uh extension of our meeting we um get to do that at this time before 10 30 so if i can i'm moving extension to 11 30 i know that we have the budget um would you be open to extending that till midnight sure just in case because i know we can only extend it once trustee travis you second that yeah okay so moved by uh trustee quintero second by trustee chavez um we'll go ahead and take the vote hi trustee chavez aye trustee fem aye board vice president quintero hi and myself i will go ahead and move the mini 2 up to uh midnight tonight hopefully we're done before that but with that i want to take a 10 minute break so um let's take whatever you have
256to do at this time ten minutes and we'll see you back here at 10 30. do we need to take a vote on that no okay so we'll see you guys back at 10 30. thank you i asked you something real quick korina um for the future can we have like a stopping point on the brakes because like from five to ten o'clock that's a long time without a bio brake that is a long long time yeah can we can we kind of yeah let's discuss that offline thanks great idea okay thank you uh so how long is this going to be oh an hour [Music] well you don't have to it's only once a month you um if you can raise your hand if you are back you want to make sure um we
257have quorum before we start again let's see i'm back thank you we have quorum thank you for returning um and just uh confirming do we need to take roll call after the break no as long as you you established a quorum i think you're okay okay all right so moving forward to item 601 approved second interim financial report um dr bauer is mr cheng gonna report on this who is going to call mr cheng okay welcome mr chain thank you madam president um if i can have access to share my screen to upload you have access yeah have you should have access thank you uh great thank you can everyone see the screen or the presentation yes yes perfect okay i'll get started good evening everyone um my name is kabara chang i'll be presenting
258the second interim tonight um and with that some of the topics that we'll be going over are a refresher of the budget cycle and why we need to do interim reportings go over some key assumptions that we use in preparing our second interim and providing you with an update of the multi-year projection and also considering what next steps are and some future considerations um just a refresher on the budget cycle um you can see here that on a normal year the four circles would be kind of the reporting period you will start off with the adopted budget first interim second interim and the unaudited actuals obviously this is not a typical period there were frequent and drastic changes from the adopted budget um and which resulted in us doing the 45-day revision um in august
259uh august 3rd on august 13 2020. the first interview was presented to the board on december 17th we're here at the fourth bubble which is the second second interim uh because the district is in a qualified status i need to present a third interim which we're done in may and then we start closing our books in june and present our on honor actuals in september so why do we do um interim reporting it is required by edcode we are required to do at a minimum two interim reportings during the year one in december and one in march um the second interim itself includes a snapshot of the district's financial position as of january 31st um 2021 2021 and it also includes the multi-year projections for the current and two subsequent year um as i mentioned
260before um the reason why we do this because of the constant changes um and those are the lists you see there it's not comprehensive but it's some of the major uh factors that we consider um in terms of um when we update our our budget um i'll go through some of the lists enrollment and ada staffing changes obviously budget had a significant impact on school districts this year federal revenue had a tremendous impact on school districts this year as well um any changes in labor negotiation and cash flow um any and also any new laws impacting um school districts um the first sets of enrollment i mean of assumptions i want to go over is enrollment um this graph right here shows you um the work that was done with the demographic study by um
261our consultant that we um carried back in in that presented to us back in in november as you can see here on this chart here it shows the district has been constantly in declining enrollment um going back to 2011-12 actually further but this report only captures up to um 2011-12 where the district's involvement was at 12 and then coming to this year dropping to and then in six years um in 2026-27 um the enrollment projections shows the the districts will be at six thousand six hundred and three uh students um this chart here shows you an enrollment projection but based on um the seabed count cbed is is the system where the state certifies um the number of students that the district is serving now the the difference here is that c-bet numbers do not
262capture um our young t-4s those are students who do not um turn five years old prior to the december third um this event report does not capture that in addition to that it also capture our special um special ed preschool population so that's why you see the difference there um and again um you know the district is projecting to um still be in the declining road um uh throughout the the next three years i'm sorry can you can you go back to that one and can you just what is py i'm not sure i quite understand i tried five years see why it's prior yeah okay and so can just in a nutshell can you encapsulate what this is demonstrating again yeah this just shows you from year to year the uh number in declining
263enrollment and so for example oh okay yeah so it's not specific to those p4s that you mentioned okay yeah yeah this the seabed reports that we submit to the state um do not report um those populations the t-4s the youngsters call them and also the pre-school um specialized people okay thank you you're welcome another assumption we want to go over is the district's lcf revenue so for 2021 lcf will be funded on 2019-20 p288 we do not receive any cola for the current year i mean for the current year the state is not collecting ada for the current year but school districts are still required to take attendance for next year it's also based on the greater of 2000 p288 since we're not collecting ada this year um next year funding will be on 2019
26420 p288 um a huge change from our first interval report is that um the state is proposing to provide 3.84 in cola at first interim um the state did not propose any um any cola increase for 2022-23 again this is based on the current um greater of current year and prior year so this is where um you will see a significant drop um because of the the declining enrollment um and the state catching up in terms of what ada to use for funding um a relief in this year is that you know the state is also proposing um to increase the cola or to provide a cola of 2.98 and remember at first interim the cola was zero for our one charter school aptitude funding for 2020 is based on the space 2019 p280a no
265code for this year um similar to um our traditional souls the state will not be collecting 88 for 2021 but attendance taking is still required um there was a slight change um in statute for or in proposal for 2122. um in in the previous proposal uh charter school was was also receiving the um hold harmless in terms of um being funded on the greater of the current or uh previous year um but in the january budget proposal the governor is taking that relief away so it would be on current year ada however similar to school districts to traditional school districts um charter schools will also be getting the 3.8 um four percent cola which was a zero at first interval and then for 2223 um the funding was based on current year ada um providing
266a cola of proposing a coal of 2.98 um and again as a reminder it was zero at first interim so what does that do to our lcf revenue as you can see here in 2021 we are showing a net loss of 500 and ten thousand dollars um for both um the the districts and aptitude and the reason for the reductions is that even though we are funded on uh 2019-20 ada they they they factor in also um the the adjustment or the decrease in our unduplicated count um because if our undue carry count goes down um that would affect our funding so for the current year we're showing a net loss of 510 000 um in lsat lcf dollar but if you move over to um 2021-22 you'll see a net gain mainly due to
267the cola of 2.5 million and then moving forward to year 2223 you see another net gain of 4.4 so under aggregate over the three year um lcff calculation um you will see a total of net um a net net gain of six point close to 6.5 million dollars in lcs lcff revenue another question so i think i heard you just say that six four eight four that's an aggregate of those years total not just an aggregate of 22 23 but it's it's the the net between 2020 through 23. correct yes yeah the year by year you'll see um like you know the first year or the current year a net loss of 500 and then yeah thank you thank you um other revenue to consider um you know we we did receive a huge relief
268um in federal one-time funds um um and and we're budging that for next year um so the the the federal government approved um another round the second round of esser funds which equates to 10 million approximately 10 million for the districts um and will be reflected in year 2122. and based on the recommendation of the county office since our partial tax will be expiring after at the end of fiscal year 21 22 we're removing that household tax revenue at this time um and until the voters approve uh for those to continue um then we will add then we will add it back in um in the event that voters approve partial tax to continue so that was on the revenue side on the expenditure on the expenditure side um districts is assuming an increase in
269stepping column for all three years um pers and stirs rates are based on the governor's january budget proposal um an increase in contribution for special ed programs in the out years um and to require the statute maintain a three percent contribution to our routine restricted maintenance account for all three years as well so for fiscal year 2021-22 expenditures from unrestricted general fund that was paid with one-time federal federal funds will be will be added back um to the unrestricted general fund um we'll also be backing out any one-time payment that was made in 20 um 2020 21 for the 2019-20 and the 2020-21 settlement we also included in the reduction of 20 certificated ftes at an average of 85 000 salaries to align with declining enrollment um and here you will see because of the
270esser fund we have um we have we're showing a transfer of approximately 10 million dollars of allowable expenditures um from the from the unrestricted general fund to the restricted general fund to utilize esser fund and the reason why we're doing that is that um when the government when the federal government sends us that money they require this to put it in the restricted resource but allows us use to use unrestrict expenditures um to go towards those funds for fiscal year 20 to 23 um we've included a reduction of 15 certificated ftes um at a average salaries of 85 000 to align with declining enrollment um the certificate of participation which is also known as cops payment of approximately 2.3 is not included in the general fund we will need to be we need to issue
271measure i bonds for repayment um for repayment um of that obligation um and you may recall that um at first interim um we had identified 7.8 million dollars of unspecified reduction to be able to meet the three percent requirement um we have eliminated we have removed that um due to the infusion of a lot of this one-time funds from the from the federal government so with that this chart shows you the multi-year projection for the unrestricted general fund as you can see here starting with 2021 we started the year with approximately 12 point close to 12.5 million dollars we're projecting to receive we're projected to receive um a little over 107 million dollars in revenue total revenues our total expenditures is approximately 83.8 million dollars the contributions the 22 million dollars 22.5 million dollars in
272contribution transfer out is mainly um to to go towards um supporting our special ed programs and also our routine maintenance um as you can see due to the infusion of one-time money um the district is showing that it's it's adding to our reserve um from 12.4 million dollars and increasing it by 800 000 um to a total of 13.2 million dollars um going over to next year we start the year with 13.2 million dollars um projecting a total revenue of um 100. 109.8 million dollars um i want to draw your attention in the expenditure area um in the previous slides when i mentioned that we were going to transfer unrestricted expenditures from the unrestricted size to the restricted side you'll see that in the other adjustment column right here or in the other adjustment row
273this is where we're showing that we're going to be transferring that money so the 10 uh the 10 billion dollars in the other adjustment reflects that to be able to use the essa funds in 21 22. um and again the 24 24.4 million dollars in contribution transfer out is for our special ed programs and also our routine maintenance um and again due to the infusion of one-time money we are adding to our reserve we started the year with 13.2 million dollars we're projecting to end this year uh with 18.4 moving on to 22-23 starting the year with uh 18.4 as you can see here um our revenue is taking a steep dip mainly due to the whole harness provision going away for lcff and also one-time funding from the federal revenue um no longer available
274you'll see a drop on total revenue from uh 109 million dollars from the previous year um to 100 million dollars in uh year 2223 the district is showing a total of projecting a total of 89.8 million dollars and i do want to again uh remind you that in that first interim uh we had a approximately 7.8 million dollars of unspecified but due to the one-time fund um the district is projecting um that it will meet in reserve um with the removal of the unspecified cuts and so we're projecting to end year 2223 with a ending fund balance of 3.9 million on the restricted general fund this year we started the year with 2.2 million dollars in carryovers the district is projecting to receive a total 34.7 million dollars in total revenue um a total expenditures
275of 59.5 and then the contribution transfer in the 22.5 this is the contribution from um the unrestricted side to support our special ed program and our routine maintenance we're projecting to spend all the carryovers from last year so we will end up the year with no carryover moving over to year 2122 the districts is projecting um to receive a total of 26.3 million dollars in uh total revenue um 50.7 in total expenditures um a transfer in for special ed and routine maintenance program uh from the unrestricted side um a total of 24.4 million dollars um with it ending with zero in our carryover um in year 2223 the district is projecting receive a total of 16.1 million dollars and again you'll see a steep um decrease in revenue because the revenue the one-time revenue from
276the federal government no longer is available in terms of total expenditure the districts is projecting to spend 41.2 million dollars uh which is supported by a contribution from the general fund um totaling um a little over 25 million dollars and coverage if you could please just clarify so ending with zero balances in this on this particular slide is what we want to do because these are restricted funds and have to be spent towards um specific items is that correct that's correct thank you for that just for public who's wondering why we have zero balances down there thank you so next steps and future consideration um you know negotiations negotiations um have started for us with a couple of bargaining units for next fiscal year the impact of the 1.9 trillion american rescue plan um that
277um that president biden just uh signed up on today so we'll we'll learn some more details on that um in the coming days um again we'll be presenting our third interim report in may um we're gonna be eagerly waiting um for the may revise and what kind of changes um the legislator and the governor is proposing um in terms of the difference between what was proposed in january and some changes that might occur when the may revision is presented and with all that information we'll be preparing a public hearing for next year's budget sometime in june and in june the district um is required or by july 1st of this year the each district is required to adopt um their budget and el cap and that would be done sometime in june of this year
278with that i'd be happy to take any questions thank you so much um so with that um i know that um [Music] i i will go ahead and open up for a public comment first and then we'll move on to um trusty questions and comments as we formulate our thoughts um mr moran do we have anybody from the public wishing to address the board on this item yes we do we have two people the first person is ana robles gracias is foreign yes yes anybody else mr yes we have brenda sindejas welcome back mrs as soon as you begin speaking the timer good evening board members superintendent codina um i have a question so i see that you put the numbers in here but the parcel text is not for something so is that number
279projected in 122 and 22-23 or are these numbers without the parcel text i don't know if i missed it um just i want a point of clarification on that and then i see that we are spending close to almost everything that we have so we have 107 for example million and we're we're spending 83.8 million and putting 22 for special ed and maintenance so are we having any savings in any year because i i don't see any and i keep seeing the deficit go bigger and bigger every year i understand that ada enrollment is a big factor in this but as a district are we saving any money and is the surplus tax in here or is it added or decreased every year and if you can respond i mean i would appreciate it i
280know that board members respond when i call out their name but they don't respond to my questions so maybe if you can please uh clarify those um i would appreciate it thank you mr mrs has anybody else mr moran yes we have maria carrasco welcome mrs carrasco as soon as you begin speaking the timer will begin um i don't know if she's there or is there anybody else mr as we figure out what's happening with ms garasco uh no board president she's the last one okay maria carrasco it's your time to speak senora maria carrasco es momento de blasi puede i'm not sure if you're see okay i was just trying to translate in case she wasn't understanding um maria carrasco one more time before we move on um it's your turn to speak as
281soon as you begin speaking the timer will begin we'll count to five okay um maria no okay mr moran any others yes we have uh karina hey karina welcome back as soon as you begin speaking the timer will begin can we mute garina or is karina unmuted yes she is tarina necessity mr moran um we'll go ahead and go back to ms carrasco to see if she's back on okay let me uh allow her to talk um there you go is she unmuted yes she's unmuted right now mr mona can you double check and see if she is unmuted or muted at this time yes she has permission to speak okay senora carrasco miss carrasco she actually just logged off okay so maybe she's having tech um internet it's just okay uh and i think
282you mentioned that was it correct yes okay so um we'll move on to board members any questions comments concerns uh trustee chavez go ahead and take the head on and then i'll i'll speak go ahead i still have to formulate my question go ahead trusty travis and we can't hear you you are you're on you on page 11 of the key assumptions of the general fund expenditures at the bottom where it says the cut the this is what i was referring to on the cops so the certificate of participation payment of 2.3 is not included in the general fund and it will be removed approximately 7.8 million of unspecified reductions so before when i um i'm here anyways before i became a board member when i was sitting in the seats i remember that the
283trustees were asking the administration about why the cops didn't get paid off and i believe that there was a plan that was in place by the previous superintendent how to pay it off my question before and what i asked for before my request was one is can i see the documentation of the plan that they had in place to pay it off yeah thank you uh could you answer why you didn't get paid off um respectfully requesting if that could be answered now yeah i'm gonna give it a shot and then i'm gonna ask is that okay for me to answer i'm asking for a present yes please [Laughter] um and then i'm gonna ask alvera to verify what i'm about to say trustee travis the plan was to use bond funds that's why it
284has not been paid so it was sort of like a debt that was supposed to be paid in the future with installments and that's the plan the plan is to use bonds to be able to pay the cops that was the plan that we inherited we were none of us were involved in that not even mr fisk who was the superintendent before me he was not involved in those transactions and so we he inherited and then we inherited and i don't know if colvera can add to that yes no i i just wanted to um confirm your statement in terms of you know when when this debt was issued back in 2010 um i don't think any one of us were here and the original plan was to use bond funds um to pay for
285um whatever is left um that the state has given us um and so what the balance was was to be able to use bond funds to pay for that and you may um you may or may not recall but back in 2018 um the board then passed a resolution um to be able to use uh you know future bonds issue and funds proceeds um to pay the balance off as well go ahead trustee travis do you have another question so trying to attain a different bond and us getting more into debt we still have to run it by scoe and with the way they downgraded us um hypothetically do you really think that we're gonna um be able to to have them pass that for us to go into debt more yes can i answer
286that uh madam president okay um so measure eye bonds which was passed back in 2016 um have not been issued again um you may recall that measure ibons was approved for close to 140 million dollars uh we have not issued against that measure i bond so the opacity to to issue um to to issue bonds um for bond proceeds is still available to the district from that measure i that was already approved thank you thank you mr chang uh yes just uh with this i know there's ongoing conversations mr chang that you have had and been having with the um county office of ed with regards to this report and the assumptions and and you know these current numbers have has there been any discussions with um your colleagues there at the office of ed
287and and are they supportive of what we're presenting here or do they have concerns or anything like what's the the feeling that we're getting at this point from office of ed if you could share any of that yes you may recall back in um december when you presented the first interim um the county cbo was present to provide some some comments and analysis of the district's financial situation at the point and one of the issue that we talked about was um the ability to for the districts to um issue any bond proceeds since we're in a qualified um status and you know their response is that you know they would support the districts in in that endeavor they understand that the districts is going to need those proceeds to be able to pay off of
288that obligation that we still have on our books um and so it does need the county support um but their position is that you know they they will be supporting the districts um in that effort okay and then oh just anything else in this report other than that particular issue that that they're either supportive of or not supportive of or or i guess any differences from that prior time when they came out i don't know if that's clear um i guess what i'm asking is knowing that office of ed is you know you know providing that kind of oversight of us with what you presented tonight is there anything that you know has is remaining a significant kind of concern i mean obviously we do have the the challenges we have but just anything in
289particular stand out from the most recent numbers you're presenting tonight we did see an improvement in terms of the the financial um relief both from the state and from the federal government um and i think this is a good segue into our next item where uh you know based on the recommendation of the county office is that you know they they they want the districts to acknowledge the financial challenges that we have um with that you know they're recommending um that the district approve a resolution to commit to take act the necessary action to do what is necessary to close that structural deficit that the district is currently facing okay thank you did i hear you correctly this resolution is coming from scoe uh can you clarify that no this resolution is a district resolution
290okay can you sorry can you repeat the last two sentences you said before i asked my question yes so the district i mean the county office would like the districts to um commit to taking any action necessary to close the structural deficit that district is currently experiencing and what a resolution that memorialized kind of the um the necessary um actions that that the districts need to do thank you thank you thank you trust each other um i'm getting an echo and i don't know why so um mr chang based on what you just said um is it um i i guess i just wanna or even dr bauer uh based on what mr chang just mentioned we are therefore right based on what he just said we are therefore having this committee that's currently meeting
291to then give us recommendations to then uh you know possible school closures we don't know how many we're gonna wait for recommendations etc is that correct is that part of that process and the reason why and i want to highlight the concept of school repurposing because when you repurpose a facility you're able to use it in a different way that may generate revenue stream this is a difficult conversation to have at any level and i totally honor the heart and the anxiety and all of those things and i this has been um an issue for a while um in terms of the declining enrollment all of this goes back to that um there's a lot of uh misperception i i guess that's the words that that needs to be clarified and i urge um the
292public to attend meetings and to be informed and to be updated because it is a complex trajectory right to understand what has happened to the district i think that the best um support that we have from the county office of ed is that they believe in the work that we are doing so much that they are supporting their pain for our strategic plan so that's a huge support from them saying keep on going keep us steady it is difficult it's been difficult for a number of years but they know that we're moving the district in the right direction so thank you for your question thank you and mr chang is it also i know we're all excited about you know money that is coming down i mean you you know touch on it a little
293bit is it safe to say that in may um we will have more of an idea of what that money looks like it's um not reflected today right because i think you mentioned the next couple of weeks we'll be finding out exactly how much is coming to our district yes by by by may we should have a clearer picture um both um you know funds from the federal government and the state um right now you know what's included in the budgets i think that are uh pretty certain so um the cola itself um you know it's it's pretty straightforward um there are a lot of proposals that are still awake making its way through the legislators and the budget committee at the state level so um there could be some changes from now until may
294but we'll get a better idea um mid-may when when the governor presents them a revision itself [Music] again i appreciate the the public you know and the comments um especially one that i heard about being worried about not having enough savings right and so that's that's part of that difficult conversation and so um yeah i look forward to continuing to work with our community um hearing the feedback hearing the solutions to make sure that we not only have our district good and this year next year and maybe even the third year after but for generations to come so that we set them up for success so hard work but i'm looking forward to continue you know to roll up our sleeves and get the work done any other questions or comments from the trustees before
295we move um forward i actually just if i could make a brief statement to reiterate and echo what dr bauer had mentioned um you know i think everything that we've done with regards to our budgetary process and frankly everything else has been very transparent the information is available out there for the public to see um and so you know i just say that because everyone's comments are correct like we all need to be on the same page with this this is a difficult journey for all of us but but the information is there and so you know certainly in these meetings to the extent possible we try to address it we ask questions of mr chang to try to clarify some of that stuff and things like that but the bulk of that information is
296is you know widely or it's completely available to the public to see um and to have further reference and i know those have been specific um requests from the public to see you know evidence and things like that and and we have that is out there so um you know that's not to say that you know dr bauer mentioned meeting with the public and and all those types of things but um the hard evidence of that documents this whole uh journey that we're on is publicly available thank you trustee i would also like to add um that i want to appreciate trustee chavez and yourself for um having a budget committee meeting a couple weeks ago to do our best to inform our community so thank you for having that i know chelsea chavez dr
297brower and yourself will be confirming a date in april um so just continuing to um remind our community to to show up to those meetings and you know have your questions and continue to continue to be involved we appreciate all of your involvement um with that at this time i don't see any other hands um if i remember correctly we don't have a motion on this yet uh i'll motion to approve thank you mr pham thank you trustee chavez uh so now that we have a motion in a second i'll go ahead and take the vote uh trustee vijarano hi trustee chavez aye trustee pham hi board vice president quinteno i and myself i passes unanimously thank you moving on to 602 mr chang is that also you thank you madam president um this item
298before you um as i mentioned earlier is a recommendation that we bring to the board for the board to consider um in terms of the resolution to commit the districts to um fiscal silency and if you can indulge me i would like to read the resolution itself in its entirety just for the record yes thank you thank you so resolution number 33-20-21 a resolution to confirm alum rock union elementary school district's commitment to fiscal solvency whereas the board of trustees of the alum rock union elementary school districts has a fiduciary duty to meet its financial obligation in the current fiscal year and two subsequent subsequent fiscal year pursuant to education code 42127 and is currently in qualified status whereas the allen black union elementary school districts recognizes that the 2014 measure of voter approved parcel
299tax will expire at the end of fiscal year 21-22 and if not extended by voters of the alam rock community that will result in an ongoing revenue reduction of approximately 4.5 million per year whereas included in the district's current budget is one-time federal funds to address covet 19 pandemic of approximately 14 million dollars and 10 million dollars in fiscal year 2021 and 2122 respectively whereas the board of trustees of the alumni union elementary school district recognizes the districts has a significant structural deficit that must be resolved in 2020 21 and 2021-22 there is a infusion of one-time dollars from the state and federal government to address covet 19 related expenditures and the impact of declining enrollment has been temporary temporarily mitigated because of covet 19 related measures but in 2022 23 the district faced a
300structural deficit as noted in the second interim report of approximately 14.5 million dollars this is unrestricted income less unrestricted expenditures whereas the alambak union elementary school district has a certificate of participation debt repayment of approximately 2.3 million dollars per year with identified funding source through years through year 2122 and starting and that's starting in fiscal year 2223 the repayment plan provide for the remaining 8.5 million dollars in debt to be paid from unissued measure i bond proceeds or it will otherwise become an obligation of the unrestricted general fund now therefore be resolved based on the above recitals and in order to ensure that the alan rock union elementary school district remain fiscally solvent the board of trustee is committed to reducing expenditures in all budget areas including total staffing benefits services and operating expenses capital
301outlay and other outgo and is also committed to examining potential source of revenue including but not limited to the repurposing of excess facility to generate facility use or leasing revenue the board of trustee is committed to taking appropriate actions to begin addressing these projected funding shortfalls adoption of the 2122 budget in june of 2021. thank you thank you move to approve by board vice president quintero we'll go ahead and open up for public comment at this time mr moran do we have anybody yes we do we have brenda sandejas welcome back mrs as soon as you begin speaking the timer will begin um i have a question on this resolution um i was seeing the the i would say suggestions for capital outlay outgoing and staffing total staffing does that include only staffing teacher staff
302classified or does that include admin level as well because i don't see that word here so i just want to make sure that total staffing means everyone or does that just include classified and um teachers and um other unions or employees in this district so hopefully you guys can finally answer any of my questions but that is just the question that i have what does total staffing mean thank you miss andejas mr moran anybody else uh she was the last one no no more okay thank you coming back to the board um do we have any questions or comments concerns from the board okay seeing none uh we'll go ahead and move to a vote uh start with trusty gerano hi trustee chavez aye trustee fem aye for vice president quintero thank you passes unanimously
303all right um moving on to item dr bauer is that you yeah sandra uh garcia is ready to do a very brief presentation maribel she's going to need um the ability to share her screen please great welcome back uh miss garcia and uh just to as you're sharing your screen i'll be reading it off um 2021 federal program monitoring report of findings and some for information only thank you good evening uh once again everyone sandra garcia i'm going to be sharing a brief report on the federal program monitoring that took place in early february as you remember back in november december i presented um about the fpm that we would be having in february and that we were preparing for i just wanted to share some brief details of the report so um just a
304reminder of the timeline we started with training in july the deadline for collection of evidence was december and january and then our review was in february so it was a pretty long process and then it culminated in the review february 8th through 12th again it was a central office two elementary schools and well one ka one elementary and one middle school um that were involved in the review so some of the details of the review we had eight areas reviewed um which is uh quite a lot last time we reviewed we were reviewed in five areas so we had an extra three this time overall there were 203 requests for um samples of evidence and 630 samples that were actually uploaded to the cmt site to satisfy the review we had 53 staff interviews and
305a total of 82 possible findings for our review so i'm just really proud to announce that overall out of 82 possible findings we had three findings for our district so very proud of that um of that that result um and just wanted to share that with you and kind of um celebrate that in five of the areas we had no findings at all and was just due to the hard work from everyone involved all of our district managers and principals that were involved in the review and i just think it's really a cause for celebration that you know we were able to um satisfy the requirements under the review and um have only three findings i'll very quickly just tell you that um the three findings um will be satisfied very soon the first finding
306is just um an evaluation that needs to be done by the principal at one of our elementary schools and she's already in the process of doing that and then we'll upload that information and we'll take care of that finding and have that resolved very soon the second finding is some revision of some documentation for time and effort for some of our federal funds um and all that is is just a revision of the way we document our time they just want more information included in the documentation so after we do that we have to keep track on the new system for about a month submit it upload it and then we'll take care of that finding and the third is pretty much done because you approved the williams complaint policies and procedures um i believe
307in february and the last piece we need is for you to approve the minutes tonight so that we could submit that and we will be done with that finding and once we're done with that we're all done for our fpm this time around and like i said the next steps are just submitting all of the documentation and that's it and we're done thank you ms garcia yeah i just want to thank real quickly the fpm team i mean these people um were receiving uh phone calls from me emails and you know in the evening weekends you know and we just had to work very quickly because it is time sensitive and um you know when they ask for documentation especially the week of the review you have to be on it you have to put
308everything else aside and get them what they need so just want to give the team you know a shout out and say great job to everybody that was involved yes thank you so much thank you ms garcia for your uh presentation um thank you staff and i just want to be mindful of the time um we did extend our meeting until 12 we have many items in a closed session um well still left to so um any questions i see two hands uh trustee carano and then juicy chavez another question just a quick also um thank you very much for the great work that's a exhaustive um you know process and to only have three findings and those three be fairly minimal is is impressive so just thank you for for the hard work everybody
309thank you trustee chavez i was going to say the same thing and thank you all uh to the staff and on the second one of the they put up three uh things not the last one but the second to the last can i get a copy of that please absolutely thank you sandra thank you so much seeing other hands i'm moving on to 801 resignations dr bauer uh it's information only and trustee chavez the slide that the slides that sandra presented are in your book thank you okay um do you want anything you want to report on that or on you know 8.01 is just information and i think 8.02 is super important so if the board um yes um and they're all important so but yes we have the information in the book um
310information only resignations we can read in there who's resigned we'll move on to 802 ratify one-time off-schedule payments to cse bargaining unit members pursuant to me too provision for 2021 school year um for purposes of moving forward if i can get a motion i see you had a hand up oh for vice president quintero moves to approve second that you had your hand up just real quick did we did we take public comment on the other items do we need to take public comment on those on the resignations on the the 7.01 it was information 8.0 but don't we have to take public comment on every item [Music] on 701 yes yes okay thank you for catching that um 701 sorry let's go back uh public comment anybody mr moran have their hands up for
311that item yes we have one hand uh it's anna robles okay as some members of the community we have the right to have a copy like the members of the board um is foreign i'm sorry i didn't hear the question can can you repeat that please what she said last melina can you repeat that no loss she wants a copy of the presentation like we do thank you last question the last question she asked did again you heard christopher you said when you have space on your agenda can you me can you make space to meet with us all right thank you yes um and then i just want to uh remind the community that we are in item 701 federal program monitoring very part of the findings that ms garcia gave um anybody else
312mr moran yes we have uh brenda sandejas welcome back ms as soon as you begin speaking the timer will begin i i thought we were in another item but since i am speaking i do want to address the board again that you refuse to answer questions that i said but you guys respond to others and i don't appreciate you guys that keep ignoring my questions um i am a taxpayer i am a community member and i deserve the same respect as everybody else in this community and no one has still addressed my questions do i have to call you by your name because i feel like the only time i get a response in kentucky's uh chest is if i say his name um which is sad that you respond only to attack a community
313member or to defend your honor or whatever you want to call it so i would like the same respect as everybody in this community thank you for the reminder ms um yeah we cannot uh talk back and forth with the community uh just a reminder mr ramadan do we have anybody else in this item um no more thank you uh now we'll move on madam madam president not speaking to any comments that were just recently made but just uh i'm i'm addressing you and uh just want to make sure that if you can remind the public that there's a board book that is on our website that gives access to that precise report that is being requested that on page 36 of that board book is where the presentation begins so i'm just wanting to
314have a dialogue with you about that particular uh item which is there's a board book and if if you might be able to remind the public that it is freely accessible available on the website same exact reports that we all receive as board members are on our website and arusd.org thank you trustee quintero as you all heard um that information is on there um moving on to item 801 um can i say something is this in relation to the federal program monitoring report of findings [Music] we do have many items still that we need to address so i just want to make it in relation to what uh trustee quintero just spoke about and what the lady requested they can also request the board book and it could be sent to their home and at
315their cost thank you thank you okay moving on to item 801 resignations dr bauer information only for president information is in the book thank you item 802 ratify one time off schedule payments to cse bargaining unit members pursuant to me two provision for 2021 school year i know we had uh trustee quintero um motion and trustee pham second yes that's still correct yes that is correct um so we will move into public comment on this item we have no public comment no public comment i'll count to five any no uh none okay moving on uh we will go ahead and open it up for trustees comments questions concerns see none at this time we'll go ahead and move on to uh votes uh trustee bahrano and myself i passes 41. all right moving on to
316uh consent [Music] i see a hand trusted travis yeah is this for consent calendar for the one that just finished so when i was in the uh of one of those trainings as well as the district secretary it was also put that the one who votes no could that could be noted why that was a no and the reason is we just finished um voting on fiscal solvency and here we are doing uh payments out and i think it's contradictory to what we just voted on thank you thank you trustee chavez moving on to consent calendar um anybody want to pull anything before we approve uh trustee vacarano i wanted to pull 9.09 anybody else okay seeing nothing uh we'll go ahead and um uh pass a consent calendar without 909 um well i moved
317to approve the consent calendar with the exception of item 9.09 thank you second by trustee quintero uh miss chavez trustee chavez you have your hand up and you're on mute i would like to pull 9.10 as well you also want to pull 9.10 so um are you both okay with pulling 9.10 yes okay because i know you motioned with everything except okay um with that i'll open it up for public comment at this time mr moran anybody on for public comment then board president one to five any now none okay so i'll go ahead and move on to any comments concerns questions from the board seeing none we'll go ahead and move to vote trustee chavez so we're voting on the content consent calendar except for nine the ones we pulled out okay thanks bye
318uh trusty femme aye board vice president kimbero i and myself i um now moving into 90s 909 909 uh yes thank you uh just a quick um suggestion in the third paragraph the one two three fourth line where it says um conducting exercises remembering the life of dolores huerta i would suggest that we change the phrasing to maybe something like acknowledging the life of the lord just because luckily is still with us and i feel like when we say remembering the life of it makes it seem like she's not with us at this time and so i just was suggesting that we change remembering to acknowledging thank you minor difference but i think it makes a difference in in acknowledging her the work that she is currently doing and that she has only done in
319the past she's still working on it absolutely thank you um any others um with that uh you are you i moved to i moved um to include that language replacing remembering with acknowledging and with that um change to i move to approve the uh resolution uh we're going to put second by uh board vice president quintero go ahead and open it up for public comment mr moran yes welcome back as soon as you begin speaking the timer will begin i want to thank you guys for this resolution i think that dolores huerta is a pillar in this community and um i would want to suggest that instead of acknowledging you say we celebrate um all her efforts and advocacy in this community because she still continues and i think those are moments we have to
320celebrate um and i just want to thank you guys for this resolution because she did a lot for our uh undocumented um community and our farmers and she continues she continues to thrive and uh fight for injustices in our community thank you any other members mr of the public thank you um and with that i just want to uh just acknowledge um her presence in my life she's been a mentor and i'm just honored to know her and the ways that i do so thank you for continuing to proclaim this and include this resolution and just also calling all of our teachers to do their best to include it in their teachings in one way or another i know that you know they're it's more difficult this time but you know to be creative and
321include um something where our children learn about her is important and there's so many resources out there so um yes thank you for for doing that and acknowledging dolores in our community with that if i don't see any other hands we'll go ahead and move to vote um trustee chavez there's something you want to say before we move on i guess i'll wait to the boat and then and then i'll um i'll ask for it to be on record thank you uh i'm sorry ask for what to be on record go ahead do the vote i'll go from there is there something a comment that you have to say on this otherwise after the vote we're gonna move on to the next item okay so like i was talking earlier about that if you do
322do a no vote you can put down why you're a no vote thank you do you want to say right now why are you i'll do it after i do my vote thank you okay uh trustee just real quick in the future if any of us have a reason to vote no on an item i would be interested in hearing that prior to the vote because it may change my consideration if my colleagues have something that i feel is valuable to contribute so i understand the the reason for wanting to hold it to the end i guess but i would appreciate hearing that perspective in my vote but for this if you're calling for the vote my vote is i russia chavez no trustee founder oh go ahead and here's the reason why okay dolores
323huerta was part of the ufw an organization that openly was racist against mexicans and they were both documented and undocumented thank you mr from i trustee quintero hi and myself i uh motion passes 9 10. madam president yes um this whole deal of talking while we're voting is not in accordance with except a parliamentary procedure uh there are there's a motion that's made there's a second and then there's opportunity for discussion and then there's a vote and once the vote happens then you either vote or and that's it so there's no i'm going to give an explanation while i'm voting parliamentary procedure doesn't allow for that at least in uh you know robert's worth of water unless you go ahead and pull it out and show it to us uh then i would suggest you
324stop uh disrupting and please we have the attorney here who can uh yeah mr thank you mr ruiz can you please clarify that so you uh the board has a board policy which i'm looking at right now it is bored by i'm sorry board bylaw 93 24 and what it says because this is information that would go into the minutes of this board meeting is that the minutes will include a brief summary of the board's discussion on each agenda topic rather than a verbatim record of each board members specific points of view during the discussion so so during the discussion during the discussion is appropriate but not during the vote that's how i would interpret your board by law this provision yes thank you that's correct yeah okay so um we'll move on to nine
325ten uh be mindful of time as well uh trustee chavez um are you moving to approve that for the purpose of discussion so can i have a clarification please so if i do vote no i'm not saying that it has to be verbatim but i'm just saying that what i heard in the brown act meeting from lozano smith and um the district secretary was there as well is that you the no vote is allowed to state the reason why it was a no vote so is that incorrect um mr rogelio so i'm not i'm not aware of which which version of the board policy that they were looking at but i'm what i'm looking at here which is this district's board bylaw is it says it's the minutes she'll only include a brief summary of
326the board's discussion on each agenda topic rather than specific points of view so in order to how should i say in order to get something on record the bylaw would have to be changed or because of the way that it was instructed to us in the brown acting training course the way they said that it can reflect the no vote what was said and it doesn't have to be verbatim but the reason why so linda can i can i um i know mr rogelio answered that already several times so it sounds like you can answer and you could put it on record during the discussion when you say i will vote no because x y and z but when we're voting you can't have a discussion at the time um so with that we'll go
327ahead and move on to 9 10. i know you pulled it do you want to move to approve for purposes of discussion no i first want to make my statement um cesar chavez was the leader of the organization united farm workers and cesar chavez used racist comments against mexicans and which i'm not going to repeat but he would also call la migra which is known for ice on undocumented workers and there would be fights at the borderline that were cesar chavez union you united farm workers thank you okay thank you i'm confused maybe we're not talking about the same cesar chavez but i'll go ahead and move to approve for purposes of continuing with this vote i move to approve um second this resolution on cesar chavez second by trustee vegarano i'm going to go
328ahead and open it up for public comment uh mr moran do we have anybody on for public comment uh right now we have none okay count to five uh any now still none okay great thank you so much um i see trustee chavez's hand up yes there is documentation and you can go to videos where he was calling them that in the 1960s i know you weren't around and neither was trustee vegeta but i was and i seen it my husband experienced it in the fields and where they were fighting the union so like i said he was racist he always has been always will be thank you thank you and um as maya angelou says i come as one but stand us ten thousand and i know that my father was a farmworker and
329i know that cesar chavez helped my dad and many other farm workers so i'm here to speak up on behalf of cesar chavez and all the work that he did to honor his life especially here in san jose california um at the alum rock school district where his home was at trustee vegeta yeah just uh just because i was called that by name i don't know why i was brought into that but um i think i do believe that you know and maybe trustee considered correct me but i do believe there's some accuracy to the statement that's being made i think that is there is some accuracy we're talking about you know whatever 50 60 years ago times were different terminology there was different times but in turn in terms of this resolution i think
330the spirit of the resolution um is what we're looking at here and for that reason i support this um that's it that's all i'll say for now thank you trustee can uh before you um speak i'll have you speak last since you haven't been able to speak on this item yet and we're gonna go ahead and move on to um the uh closed session after that because we do have some important items to discuss trustee quintero uh yeah just i think it's important to uh get the full context i have family members who were uh very supportive of cesar chavez's efforts and family members that were on the receiving end of the difficulties i'll put it that way and uh the the context is that you had people who were out there suffering because they're
331on strike they didn't have resources they didn't have money and you have people who are trying to break that strike and cross through and so this is uh you know collective uh this is uh the only commodity that workers have which is their labor and they're going out there trying to better the conditions people are crossing the picket lines and so it gets pretty rough so i think it's important to get the full context and not simply go off of a couple of statements that were said in the heat of the moment while you you are acknowledging that you have your members that are going hungry because somebody's crossing picking lines and stuff of that sort and so it's important to get the full contacts that's that's why i wanted to go ahead and add
332those comments thank you trustee quinteta we'll go ahead and move to the vote uh trustee veterano hi rusty pham hi rusty chavez no uh aboard vice president quintero hi and myself i passes um and we'll move on to closed session dr bauer any announcements before we move on we will hopefully have an announcement when we come back yeah which right now is midnight is what we have we have to end our meeting at midnight so we'll see you back here at midnight um trustees oh yes let's open it up for public comment sorry before we move up on on any of the items on our closed session um mr moran any public comment at this time we have none okay down to five no still none okay um i see travis and guitero's hands up
333do you have any questions about how to log in to a closed session closing this anything in relation to this no great okay we'll see you in post session in approximately 20 seconds you said that she was here now can you see me i'm here it looks like we have quorum we're all here um um will will mr ruiz giving the report out so do we call meeting back into order and do roll call or uh yeah you just want to make sure that you have a record that you have a quorum present okay we're all present um we have a quorum si quintero fam the gerano and travis and myself back okay uh closed session agenda item 10.03 uh motion by member beccarano a second by member fam the board approved by a vote
334of four to zero a settlement agreement between the district and c alvarez and a carrera on behalf of their student a minor pursuant to which the district will reimburse parents for up to 330 dollars for academic services for this school year and the district will also provide additional education services to the student and the agreement includes waivers mutual waivers and releases member chavez had technical difficulties and was unable to vote on this item although she was present and again that was approved four to zero with member chavez unable to vote and then closed session item 10.06 motion by member beccarano second by member fab uh the board approved the the appointment and employment of avatar gill as the district's chief technology officer and as with the previous item member chavez due to technical issues was
335present but was unable to vote there are no further actions to report so much and uh with that any um requests from the board of trustees or from the public for items for our next agenda none at this time we have one i'm sorry one hand we have brenda sandejas okay um if we can unmute her she can uh bring it up or as soon as you begin speaking the timer will begin her mic is not uh working hang on one second okay mrs vegas i just want to ask um if the presentation about the repurpose can be available because um i've had a lot of parents calling me about it and it's not accessible under the air usd website and i also um want to know if we can't as a public request for
336um expenditures made on district credit cards um be given an agenda for the next meeting and explained because figment report did show that certain credit cards had a really high views and there was no uh receipts or anything uh shared and so that's a concern for me so as a taxpayer i would like to know um why was that not given and if we can get that agenda is to share with the public or um give it through email whatever is easiest um and that's it thank you mr huss and just to clarify um dr bauer did you understand as far as a request for the repurpose um i'm assuming it's the presentation that the repurposing committee are being are getting and we have i need to check the tab because that's the reopening sorry
337the reopening okay yeah i was confused i just want to make sure that we um understood so the reopening presentation i just want to uh come this is going to be an agenda item yeah i just want to confirm because this is for future agenda items you're not asking for an agenda item on this i just want um i did want to get agendas on expenditures on credit cards if that could yeah i'm sorry i understand that it was not to be agendized i just got a lot of text messages if it's not available through the air usd and some parents missed it and would love to see it so that can be shared through the air usd okay thank you i just wanted to clarify um okay any other members of the public um
338mr moran that want to address the board for this item uh no other members okay thank you and at this time we'll join the meeting at 12 34 i'll see you at the next uh meeting special for me thank you have a good night
