009to be passing it on to Miss Sandra Garcia who has a presentation and just please um open the public hearing right after that okay thank you hi can I share my screen please um superintendent Dr Bauer and members of the board and the community my name is Sandra Garcia and I'm the director of state and federal programs and this evening I am going to present information on our learning continuity and attendance plan the first draft of this plan so in order to begin I would like to share some background on the learning what the learning continuity plan is um in the past we have been asked to update um the lcap which is the local accountability control plan on an annual basis and if you remember this summer I explained to you that um the

010state was looking at um a different plan for us to implement this school year for one year and this is what we have been asked to do and the name of the plan is the learning continuity and attendance plan so for the 2021 2020 2021 school year the local control accountability plan which was to be due in December is now replaced with the learning continuity and attendance plan this plan is to be approved by the school board by September 30th 2020 to be in compliance with the law so this evening I am going to be presenting a summary of how our district will provide continuity of learning and address the impact of covid-19 on our pupils families and staff I'll begin with an overview of our initial plans the plan um if you've taken a

011look at it is broken into uh buckets the first bucket is the continuity of learning bucket within this bucket we have uh distance learning and in in this area of the plan we share information on the logistics of our distance learning program including device access daily instructional minutes by grade level guidelines for attendance and Grading and communication platforms that we will be using during this distance learning time the second part of this bucket is devices and connectivity the section of the plan discusses the way in which we will provide devices and connectivity required to connect to online classes all students that needed a device and or needed for this year a device and hotspot have received either an iPad if they're in TK in Kinder or a laptop or Chromebook for students in first through

012eighth grade uh all students that needed a hot spot to connect to their online classes have been provided a hot spot in addition Jeopardy of nine taking these days extended their tech support until 7 pm on weekdays and ten to four on weekends the port um tech support is offered in English Spanish and Vietnamese the next part of this bucket is professional development and in this section we are to summarize the various professional development opportunities for staff including curriculum-based trainings as well as trainings on the use of the various platforms and tools that we will be using for online instruction people learning loss is another area that needs to be addressed in this part of the plan and um the the plan addresses the need to assess pupil learning loss and develop a plan to

013intervene for students showing gaps in learning this section discusses the various ways in which we will assess student performance and monitor their learning throughout the year and check to see for gaps that need to be addressed during the school year with additional interventions the next area of this bucket of continuity of learning is the support for students with unique needs in this area of the plan we are to address how we will provide additional support to our English Learners our displaced families Foster Youth and special ed students and just a couple of the ways that we have uh described in our plan are the the continuation of integrated and designated English language development services within the school day additional programs that support our English language Learners specifically PD continuous PD in this area for our

014teachers and um our support for displaced families and Foster youth are the support with our schooling Services providers and our counselors they case manage these students to ensure that they have the necessary um materials and supplies and services to be successful in school and some of those are prioritization and after school activities which are being done through distance learning school supplies uniforms tutoring and others our special ed students will continue to be monitored through their IEPs their progress will be adjusted and their progress will be monitored and goals adjusted as needed um so that we can ensure that they meet their goals they are receiving their IEP services to the greatest extent possible through distance learning through synchron synchronous and asynchronous methods and once we return to school we will assess them there I we

015will assess their learning to see if there needs to be any adjustments in their IEP goals the next bucket that we address in the plan is mental health and wellness and social emotional learning in this area we describe the ways in which we will provide support to our students in the areas of mental health through professional development that our staff has been receiving since the um school closures last March there's continuity in the professional development the site-based counseling services that are offered to our students and families after after hours Crisis Support wellness support and through requests and what we call Wellness Wendy Wednesdays for staff um social emotional learning is addressed through again professional development to help our staff really implement this um these techniques with our students and to make sure that our students

016are feeling connected not only to their teachers but to their classmates and that their growing and feeling safe and and supported through their classes one of the things that we implemented uh this fall is the morning meeting for all of our students every student begins their day at 9 00 a.m with the morning meeting so that we so that students and teachers and can connect first thing in the morning and start the day on a positive note um and we we feel very strongly that this is going to help children um feel connected to their classroom and their teacher and their and their classmates we've also um some restorative practices in komochis um to help in this area as well the next bucket for the plan is the student and family engagement and Outreach in

017this area is very similar to what we have in the lcap when it um talks about parent engagement but the other part that's added here is the student engagement how are we going to reach out to student how are we going to keep them engaged and how are we going to reach out to those students that are having a difficult time attending their classes what is our tiered re-engagement plan when we see that a student is not attending their classes it's a very specific plan that it's in tears and there's a different action as students reach a different tier in this plan so it's a very specific plan for re-engaging those students and also for keeping students engaged in their classes by making sure that you know we offer the site-based counseling The Crisis Support

018and Wellness Resources that they may need to to fill um like they they want to be in school and that they can be and that they're supported for family engagement we'll continue a lot of the things that we have been um doing throughout the years um connecting families through schooling Services through the frcs making sure that they have the support they need um during these challenging times and connecting them with Services when we cannot provide the services ourselves our community Liaisons have been working hard and trying to make sure that our our families are feeling supported and that we're connecting with them and just making sure that that they have the resources needed um during their Outreach calls and home visits um and then offering parent Tech workshops I know our schools have been very

019busy this month implementing and offering parent Tech workshops for parents who really need the support and and how to use a computer and how to use the technology how to get onto zoom and Google Classroom so that they can also be supportive to their students at home the last bucket is student nutrition and as you know our wonderful CNS department has had a plan in place since the very first day of school closures to offer meal support for our students and we are able to continue that um for our families this fall so that we can offer meal services from 12 of our school locations students will be receiving breakfast lunch and supper daily from 12 locations at our school district and once we get back to on-site we will continue to provide this type

020of support to our families via grab-and-go models to just ensure safety for everybody so that is the extent of the plan and it like I said it's a first draft and um this public hearing is is an opportunity for me to share what we have done so far in terms of writing this fund developing the plan um to hear from you to to see um your thoughts and um we will be finalizing the plan and bringing it back to the board at a special board meeting before the end of the month so that we can um have this ready to submit to the CDE one thing I also wanted to mention is that we did have a parent survey go out it is the links are posted on our website our District web page so

021please pens go out and take the survey give us some additional yeah close the door please so we can use for our um final draft of this just FYI your microphone is um not muted right now so we can hear you thank you very much um I appreciate your attention thank you Sandra um let's see I got thrown off there okay so do we have any comments from the public on this Mr Gill you're muted if you're saying something Mr Gill oh so yes um there are public comments okay so um as we've been doing and as per our board bylaws for all of our public comments tonight we will stick with what is in the bylaws which is two minutes for per individual and uh total time per item of 20 minutes that has

022seemed to work for us on practically no items have we gone past those 20 minutes and we've been able to give everyone their two minutes so we'll continue with that tonight to make sure that we can try to get our meeting done um and as always if you have to to save time and provide time for other speakers if you have a comment that is similar to a person before you you can always just use your time to ditto or second or support the person that spoke before you um but you can use your time however you wish so that being said who is the first person is Brenda zendejos before you get started I just want to um put out a reminder there's been a few times when profanity has been caught on the

023microphone so this is just a reminder to you and to the public that your microphones May remain open and unmuted a few seconds beyond your speaking time but miss and that has Please be aware of that yes thank you what type of language is inappropriate for these meetings so when you begin speaking your two minutes will begin yeah thank you I don't I believe that was not me but thank you for the reminder um I had a question um just a quick question about the survey I know that it's posted on the arusd website will this survey be linked through parent square and seesaw and other applications that parents are using with the students and how many uh schools are using the kimochis I really like that I I'm just curious um if we can

024get uh maybe more schools included with the kimochis because I think that's a really great idea for students with um to voice their emotions and stuff like that but uh that's my only comment on that and thank you so much Sandra and thank you everybody on the board thank you next person Mr Gill Veronica hey Veronica when you begin speaking your two minutes we'll begin great thank you so much Ford um again my name is Veronica um and I do want to thank beforehand uh Sandra and her team I think they did an amazing job with the presentation and thank you for presenting it um my only feedback and I think is something that I have talked already I believe rotunda is that um I was able to attend the Spanish one and we had

025over 200 participants and we were not able to get through all of the questions which was it was reasonable because there were so many participants we want to see and I know Sandra mentioned this is a first draft but um I would definitely love if we can have something ongoing for families to participate even more often now um you know as the whole district and as a at schools as well because I know some schools are doing it but um just as a whole District just to make sure that all of our schools are coherently doing or are within similar range um because that's what I've noticed some discrepancies here and there but thank thank you Sandra again and would I I'm really excited and want to see more and wanted to see more parents

026being able to participate as a whole thank you thank you Mr Gill next person uh if I could just remind I don't know which microphone is open but I did make the the reminder just a few minutes ago about profanity so everybody Please be aware that there is the potential for your microphone to be open and this is a meeting that's appropriate for families for children for students and profane language is not appropriate for this meeting so I would ask that everyone Please be aware of that and and very conscious of the language that you use thank you very much and sorry for the interruption who was the next person Mr Gill yes when you begin speaking your two minutes will begin members of the board my name is I just want to echoa Veronica

027said um I would like to um um to give my props to Sandra Garcia and to the whole staff for this amazing Zoom meeting that it was done um two weeks ago I believe Ferris film were included they were more um rooms divisions where parents could talk and actually give their feedback um also to the amazing staff that was able to follow directions let everybody raise their hands and and also Echo what they would like to see in this continuity plan I would like to also say that there wasn't enough time unfortunately there's not really enough time to go through the whole questions and through the whole items that we wanted to talk to but other than that I really like to see that we had teachers we had um other other kind of Staff

028we have principals and we have parents and Community giving their input and um just thank you for for that and thank you for making changes that always favors that community and the way that we engage so have a really good night thank you next person Mr Gill de Leon Miss de Leon when you begin speaking your two minutes will begin hi good evening everyone my name is flor de Leon I am a part of this on on the district and also our community organizer and um I unfortunately I was not part of uh of um of these uh events that happened with uh getting the uh input from the community I was on vacation and I just came back this week and I haven't even had time to review it and I know that today

029is a day to give the input and I know we also aware that uh it's gonna be a proof it's just a draft this is why did you have to speak I'm sorry can you hear me yes we can hear you there's someone's microphone again open Mr Gill um can we do our best to make sure uh don't worry yeah your time I'm gonna we'll make up for that but Mr Gill if we could just I know there's a lot to keep an eye on but um if we can keep an eye on those microphones because this thing seems like we have a lot of uh a lot of chatter tonight for some reason with open microphone so thank you and and um Miss de Leon you can continue speaking and I know you have

030some time still yeah but are you taking away my time because no the time ran down no okay so I I I'm probably not gonna use the whole time but I just wanted to say that um uh that I will love that uh sometimes uh that the district gives more time to do these things because I think the first time I hear uh it was on Thursday and sometimes I know there is a lot of things going on that we have to be uh doing at work and I would like to see there is more time uh for having uh time to meet up with uh the community you know and not only let uh Sandra by herself uh been able to to draft everything and I know that part of those uh forums or

031time or meeting that you had was to get input from the people but I always hear that there is not not always enough time you know and I think we need to make sure we always provide time in advance and recruit people and maybe that's why it's good to have an an oversight committee that can help uh and and be ready and with people that is experts you know people that is experts like teachers principals like we want to have a group of different uh backgrounds so that way we can make better decisions but thank you very much and I will uh definitely review it and also give my input and send it to Dr Bauer through an email thank you thank you next person Mr Gill none okay thank you very much so trustee

032Chavez I did see your hand up and I see trustee after that I want to thank God I want to thank Sandra for the presentation it was very clear and concise and I also wanna uh thank all of the speakers Veronica Brenda ditza Floyd that also uh asked the same questions that I did and I was just uh I had asked Dr Bauer when they had uh some of those uh for the parents to to get the the tech um I guess the tech classes up but um I would like to see more advanced notice for the parents to be able to attend those uh classes or just give them some um I guess a little bit more time so they could redo their schedule so it could work for them better thank you thank

033you trustee yeah um I have a question for Sandra Sandra um in regards to this being a draft and uh the final one eventually coming to us um when do you need feedback by to then have the final one um what's that date is she on maybe uh Dr Bauer maybe you can well I think she's her microphone is muted so Mr Gil can take her off mute do you see her Mr Gill I'm waiting for Sandra to respond she is on mute you might have to mute herself as she's at okay there we go okay um I would like um to have any information by the 21st we have that'll give us the week to finalize the draft will start working on the final draft right away but yeah if I can have any

034comments by the 21st that would be great okay um and then I just uh you know wanted to ask you that to clarify um so just reminding all parents to send any information to Sandra as our you know as our superintendent gets a lot of information so if you have anything in relation to this please send it to Sandra um and then I did talk to Dr Robert yesterday about the uh technical aspect of the plan um and so uh basically I was wondering in regards to our students and um not being able to connect um I I've gotten you know we've gotten some feedback that there's certain areas that get kicked out a lot more than others depending on the uh company that they have um so just you know focusing around that and

035I I don't know that the specifics this is a place for specifics of that um but I just wanted to you know see and and talk a little bit more about that Sandra so I'll connect with you later thank you sounds good thank you president yes I'd like to have some clarifications from Mrs Garcia okay go ahead um Sandra this is um in regards to the mental health um you were as you were reading them out I was wondering um the site-based counseling um can you explain what the counseling is going to be about when you say site-based counseling we have counselors um we have counselors and or counselor interns at every site in our district and that's by uh referral and they have been able to support students um based on their caseload so

036we are not talking academic counselors we are talking counselors at um our families or our students need you know need help with yes we have we have counseling mental health counseling mental health counseling I think that's um that's what I needed on there to see to identify what kind of counseling counselors we're going to be using um and so if we can this is a draft we can somehow change this you know or add site counts you have side-based counseling you can put mental counseling or well however you want to identify it um I have also um a question uh if you have any idea how many of the parents um to has taken that parent Tech workshops you know on relevant topics and supporting um during the school closures um but also we also

037started giving the parents um some you know uh yeah training on you know getting getting this distant learning down about how many parents have we reached here in Alum Rock so far that's a really good question and I don't have exact numbers for you but I definitely can um get those numbers and I can have Dr Bauer share them with you I do know that every school is working on um getting some workshops together for parents some have already started and we've had great reviews on how much support that has provided our families but I can get some numbers for you okay great and if if we can uh talk to our principals to reassure the parents that we're not able to be when they were being given at their site that they will have

038another opportunity I don't want the parents saying nope would I eat I couldn't go because I was I got off of work late or for whatever reason I wasn't able to be there um if we can reassure them that you know because they didn't make it on the day they were offering it that perhaps you know we can get that kind of support for them somehow okay thank you can I uh piggyback or just add on to that or I guess ask for clarification um Miss Garcia so I think I read the I believe in the packet that um that actually some of the schools their their trainings have are available um either on YouTube or or I guess I think YouTube primarily but many of the schools do have those trainings available even if

039they missed the the live training is that is that accurate wonderful principles are getting very creative with this they are recording their Zoom sessions they're recording some of them are recording their live sessions and they are they are putting them on YouTube and uh for other parents to access yes and I think that's um I mean I think that is a good idea I think the a live training and a YouTube kind of after the fact training are a little bit different but for people even for people that did attend in in person I think those YouTube or whatever they are um recorded versions are helpful sometimes to kind of review because you don't always remember what you got or what you did in the live version so I think it's helpful in that way

040and then it's helpful for those until there's another date potentially for another live training that they can at least try to get on and get the the basics of it so um you know I would just definitely support as trustee Marquez said the principal is kind of championing that that model of the recorded versions and making sure that parents are aware of that those are available to them as well um your helpful resource is RIT department has put together a list of resources for online videos as well um just basic how to how to get log onto a computer you know how to use and how to use Google Classroom so those are all resources for our families as well thank you any other questions or comments from the board trustee challenge um that be

041posted to the Alum Rock website that it the uh what the IT department did so that way they could go to those links if they need extra help please they are posted on our website oh thank you yes uh yeah I just had a couple comments and I want to acknowledge the hard work for our staff uh and um all the work that has been going into making sure that this reopening plan um is able to provide access to all of our students um particularly I want to thank the the technology component of providing those hot spots uh some of the comments that have been made make it seem as if there's you know people are not able to access and that's not the case uh here at Alum Rock if you if you need

042a device if you need a hot spot it's available so very grateful and thankful for that um I personally have been able to observe the Outreach by my children's School we've been inundated with um text messages emails um if somebody does not want to participate it's because they've had to forcibly delete those emails or the text messages because we've received plenty I'm on the district website and I'm able to see that on the main page there's access to um the information about reopening as well as uh access to that survey so thank you for all the work that's being done by our great staff to uh go ahead and connect our students and provide access to um in this education that they're entitled to um I I was uh I'm sorry trustee sorry so sorry

043trusty Quintero can I just briefly interrupt Dr Bauer needs to it's time right now right Dr Bauer Dr Bauer needs to step away for about a half hour she's um congratulations are in order to her she's receiving an award this evening and um I think it was originally on a different date but they had to reschedule and so it's in the middle of our board meeting so she will be stepping away but congratulations and maybe you can later on you could tell us a little bit about it when you come back but I believe Mr Sanchez will be in your place okay so thank you and enjoy your your award and sorry trusty Quintero I just I know she had to leave right now so no no thanks for clarifying that um I would have

044thought that she was born out of her mind for my commented taking off for that reason no I'm just kidding no but no and just in general thank you all for the work that everybody's been doing um and the Outreach uh to the stakeholders of the district making sure that there's an opportunity before the stakeholders do me involved I think that's very very important that the opportunities are there I know that our staff does go out of its way to go out there and encourage participation there's unfortunately only so much you can do and so very appreciative of the efforts that you do put forth to make sure that people have the opportunity and the Outreach that we do get tends to be above industry standard in terms of surveys and participation you do get

045out there so kudos for that work that you're doing obviously we want to get 100 but um you know thank you for the work that you're doing so those are my comments president thank you I actually would would like to pretty much Echo everything that trusty Quintero has just said I I agree I think that um as we've talked about on many occasions prior to this we are all learning we continue to learn through this process and we're learning some very significant things about our processes things that work things that need Improvement um parents are learning new things I mean we're stepping into a whole new world and you don't just flip a switch and move into this whole new reality overnight and so it's an ongoing process and I think we are doing very

046intentional and thoughtful work in that direction and you know there's always room for improvement for all of us I did want to ask just a few questions one on on page eight at the bottom of the um the like the Matrix not the PowerPoint presentation it's the other document that we received it's in the pupil participation and progress section and it talks about a report that will be available to to uh where did it go um there's a report about student participation the um during synchronous and asynchronous instruction and so I was just wondering that report do we have yet the the process or or the frequency or any information about how the board or or that report will be um available or just any general information about that I know as I just mentioned

047this is learning a whole new thing and and tracking of of the with the weekly log is is a can be a beast potentially to get that going but we do need to see what that participation is looking like so what will that report look like you're referring to the student engagement log I believe uh yes I believe that well and I I think Mr Sanchez could talk more to that but uh it is an engagement log that teachers will be asked to monitor um engagement in various ways um you know for students so we I believe it was just rolled out this week so um some training probably needs to be done on that but we will be implementing that very soon and it is a requirement that we have to um to take

048note of how much engagement we're having and how we're reaching out to students that aren't engaging in their classes so if I can add um the the weekly engagement log has two components to it uh one component is basically outlining the assignments that students are receiving both synchronous and asynchron goodness and the other component is where we capture how students are being engaged right whether they're completing an assignment whether they're doing an assessment whether they weren't able to connect and we had to communicate uh via email with uh the parent or the student and all of these are are part of the requirements from the state so we have been in communication with area trying to come up with a template that makes sense for everybody uh we are looking at using our data management

049system illuminate and we do have a draft of that we've shared some of that with our principals we're finalizing those details and we will be bringing that uh to the team next week so those are um State requirements where we're trying to make it a seamless process for teachers to be able to capture how students are are engaging and the assignments and the lessons that they're doing both synchronously and asynchronously okay thank you and again recognizing the challenge of this I just want to at least for myself emphasize that for me this this report and and how intentional we are about taking it serious and not just seeing it as like a check the box kind of thing is is very important to me because I think one thing that we know kind of in

050the professional World about um working from home and that kind of stuff is that communication and engagement especially when you're doing stuff virtually is is important and so I want and for me it's very helpful to see how we're doing with that and where we can where we should continue to do things that are working and improve things that are not um the other question I just had very generally is as I think we know that our County this week has been um upgraded or modified or changed or whatever to a different level um in far in terms of like reopening things and and all of that all of that stuff um and so just the fact that that has happened I'm just wondering as that process potentially continues to to increase and we move

051closer to some some decisions at the county level about what opening looks like of schools does that in any way impact the draft that we have here or how we're thinking about potential modifications or are we just trying to just get a grasp of the reality as it is right now notice the very first part of the plans speaks to um learning on site so that's when we're out of distance learning and how we return to school so what we had to talk about were the safety protocols that we would use returning to school and then also you know it would be up to um the board and I'm not sure if we would go back to the original plan the 90-10 plan or rolling it out you know some students at a time and

052definitely making sure that we're following the guidelines from the county okay perfect thank you very much everyone are there any other comments or questions from the board trustee Chavez uh I was in that meeting yesterday with scoey and one of the things that they said that yes we moved from purple to red but one of the worst things that you can do is also open up and then have to close the school again so that's something that we need to consider as well how soon we should open once we do get the green light thank you and even even if the county does start opening up schools it would be to depending on the County Health Department um based on the the area of the county that we live in if I can make one

053more comment I just wanted to make sure I recognize all of my colleagues um at the district office because there's no way I could have written this plan on my own um in the short amount of time that we had and I had to go to the experts and definitely reach out to them and say we need to write this together and they came forward and helped me get it done so I just really want to thank them and give them credit for supporting with this and also for our um our input sessions so thank you thank you everybody so we'll leave this item this hearing open to the end of the meeting as well and we'll move on to item 2.03 public hearing regarding sufficiency of instructional materials is there any public comment on

054this item Mr Gill no okay thank you so this so just so that we'll move on to 3.01 but just so the public knows at any point during the meeting until we close the hearing you can during public comment you can make a comment on any of these three items that's correct right Mr Mr Ruiz okay okay so we will move on to item 3.01 presentation of the citizens Bond oversight committee school size visits and information only item um is it missing galani that that we'll be presenting and if so does she have access to the screen I do okay one moment whenever you're ready um you can go ahead with your presentation all right can we see that yes thank you so good evening community members superintendent Dr Bauer who has actually left sorry

055about that Educators staff and trustees my name is Allison singalani I'm the proud parent of two arusd middle schoolers and the chair of the citizens Bond oversight committee we'd like to share with the community the School site visit we conducted late last year so what is the citizens Bond oversight committee when voters approve Bond measures to pay for repairs and improvements that our schools need California's prop 39 requires that a cboc be formed the cbic actively reviews and reports on the way that taxpayers money is spent for school construction to make sure that the bond funds are spent the way the voters approved when they pass the bond measure the cboc is accountable to the public we are not under the authority of the arusd board or District the cboc's purpose is oversight of the

056bond program transparency and communication with the public about Bond expenditures we do not have authority to choose or prioritize or direct Bond projects we're not the decision makers we're here to empower the community with the information you need to fully participate and also to hold our elected officials accountable the state law requires a committee of at least seven volunteer community members required by law to look at the way the bond money is spent and report that back to the public to make sure committee members represent different parts of the community the law requires that the cbse has a member of a business organization a parent of an arusd student who's also a member of a parent organization a member of a taxpayers organization a member of a senior citizens organization a parent of an arusd

057student and two at-large community members District staff provide Technical and administrative assistance to our committee the cboc does not currently have a limit on the number of members Beyond those required by law and we're always accepting applications for membership applications are available in Spanish and in English on the arusd website and um and community members with experience and construction accounting bookkeeping working with contractors or any related fields are especially encouraged to apply we would love to have you join us Fleur de Leon will share the next portion of the presentation with you thank you uh let's see if she unmuted I don't oh yeah she is whenever you're ready Miss de Leon it looks like you're your microphone is ready to go and I guess camera oh there we go yeah um uh good evening

058again my name is flor de Leon I also part of the oversight committee on November 2019 members of the of the oversight committee um we visited um uh three School sites uh The District staff uh help us with that so Lucha and Foreman Maxwell building um and and the one that is a maxim middle school and dorsa so uh we wanted to see some of the work that have been done with the bonds money we also wanted to see the max the building which was built and operated but the Mexican-American Community Services Agency on land of um of the district and um and when matzah collapsed in 2016 the land um and the building revert to the district who now must decide what to do with it can we go to the next slide uh

059thank you both Lucha and dorsa had installed uh HB AC systems installing the summer of 2017. deltera will stay what has both attraction manager and program manager for the project which plays them in a position to Super supervise their own work that was a decision made by the previous board majority war was a sign of as complete and acceptable by Louis Moran the district's format director of the bonds and Facilities uh before we go further I want to take a moment to thank colvera and the rest of the District staff the brought this issue to our attention with honestly integrity and Condor of facilities are conducted or or facilitated or visit that that took uh um courage because what we saw there was not pretty um can we go to yeah uh the installation was

060very poorly done there where there are visible gaps in the dark work coolant is leaking from the units through the ceiling tiles in the classrooms the units in the classrooms no longer could acquirely do it to coolant leaking there is a 10-year warranty of the system from the manufacturer but that District can't exercise the warranty with a vendor until the installation problem are corrected however the soup contractor the Terra hire to do the installation when out of business shortly after that in the meantime teachers use a portable heaters and fans uh to try to keep classrooms comfortable to uh children's to learn and um can we go to the next line yeah alucha the hbac system installed in the cafeteria is too small for the square footage of the space um Alison can you go

061and and uh share our dorses torsa yeah so dorsa had HVAC systems installed in the summer of 2017 and all of its wings and again deltera real estate was both the construction manager and the program manager for the project which placed them in a position to supervise their own work this was a decision made by the previous board majority of Esau Herrera con Tran and Dolores Marquez work was signed off as complete and acceptable by Louis Moran the district's former director of bonds and Facilities the HVAC systems again are leaking coolant you can see the leakage coming through the ceiling here at the edge of the ceiling tiles in all 20 classrooms at the school many pipe connections were not to code pipes were hung with zip ties instead of the required metal straps so

062the edge of the zip ties cut through the pipe insulation at dorsa just like at Lucha the HVAC system was installed in the cafeteria is too small for the square footage of the space so it doesn't adequately cool the room So Not only was the installation poorly done but the choice of what to put in the building in the first place was poorly done and this is the work that the district paid for in July the Los Angeles Times reported that the CEO of deltera real estate who did that work Luis Rojas has been charged with making illegal campaign contributions to a school board candidate in Southern California and 2015 and 2016 and he surrendered to authorities there following those campaign contributions deltera went on to be rewarded with more than 13 and a half

063million dollars worth of business in that Southern California School District in Montebello what our district is dealing with now is a direct result of what was at best a highly irresponsible decision by the previous board majority in failing to end the contracts with a company that did poor quality work and repeatedly displayed unethical and illegal Behavior the cboc along with many others in our community state and local lawmakers and Auditors asked and then demanded that the previous board majority end the district's contracts with deltera over and over again that board majority refused and defended deltera's contracts I want to acknowledge that two of the three board members who voted to keep deltera are not on the board anymore but it's critical that the board and the district continue to move forward more responsibly so now

064what can the district do about the faulty HVAC systems the subcontractor who installed them has gone out of business the manufacturer of the HVAC system won't honor the 10-year system warranty since it was never properly installed to begin with deltera real estate it was both construction manager and program manager for this project does not accept responsibility the HVAC systems must be repaired while schools are closed and there may be legal recourse against the construction manager and program manager so that is something that the district is currently pursuing and can't really speak further about at this point so the former moxa building sits adjacent to the Massa Middle School on Sinclair Avenue the land was leased from the district and the building was built by Maxa the Mexican-American Community Services Agency the building holds classrooms Clinic

065rooms a commercial kitchen meeting spaces a large Central Courtyard and a basketball gym and 2016 Maxa collapsed and the building reverted to the district it was vandalized almost immediately there are about 70 broken windows all of the copper wire was stripped out of the electrical room and security cameras were stolen however the scope of work analysis the district has had done previously shows that the building is structurally sound it holds a truly incredible collection of community art that tells some of the history of the people who live in our neighborhoods the space could provide many opportunities for recreation learning and services for this underserved neighborhood the board must make decisions about what to do with the building and floor will tell you more about a building that's been very special to the Alum Rock Community

066to share with you some um before and after photos so you can see how the building used to be used and how it looks today I remember participating in two events here one was a conference with the janitors Union and the other band a native Indian Powwow I remember when we had a red truck in the courtyard sorry in the courtyard uh with an old Elder with a conversation of history and wisdom from our ancestors can you go to the next slide in the courtyard you see uh on the right on the left on 2015 you see a picture of 2015. uh where the community is having an event on the right you see an emptin abandoned useless building during the date of the BC as soon as we open the doors of maps that

067a couple of neighborhood kids I showed up and use the space and that tells you that our kids and communities the space to be open again the community around maths that needs uh more Community Open Spaces can we go to the next one here you see a picture of um 2015 on the left and at 2019 one of the pictures in 2015 you see a group of kids uh doing sports and on the right you see the same mural well preserved can we go to the next one so much beautiful art it is really speaks to the power of the art that as much as vandalize has been done here the r remains almost entirely intact even the bundles can feel to can feel in strained and Power can we go to the next one

068right here you see all the pieces of art the pictures remind of resilience to be disappeared uh let's go to the next one I don't see them yeah so it is so disappointed that our kids and your Generations in our community are missing the opportunity to see and use this space um can we move to the other one here you see a vandalized part of the mural and it looks like he's uh uh Dolores uh Huerta next one please another picture in the hallway that's that's the hallway with more murals those people you see on the picture are members of the oversight committee and the staff from the district that make the school beats it possible and accessible next one some rooms are frozen in time the picture of the uh in the middle of

069the computer is a picture of the main entrance the reception area the pictures on the left is a conference room uh and the one on the right is the dining room of the kitchen it is so fortunate to see this space have not been used by the community at some point uh it felt like all you needed to do was to clean the place up and put it back in service and the last picture but so much bandel is too you you can see where all the copper wires have been uh striped um out of the electrical room graffiti garbage paper paint this is the last picture of the presentation and I ask you all to erase this picture from your memories and try to imagine a an image for the future an image where

070these community centers upper opens its doors again and uh last uh Alison will conclude our presentation Alison the board must decide how best to use the former moxa building and preserve its community art the last bid the district received for the cost of refurbishing the building and repairing the damage was more than nine million dollars so this is not a decision to be taken lightly but this would be an incredibly valuable not only preservation of this beautiful community art but also a real value to the community the years ahead are going to hold a lot of financial challenges that the pandemic has worsened our Alamo Community is going to face a lot of competing priorities and the economy is going to make meeting these needs a challenge Above All Else the community's money must be

071spent wisely in ways that benefit our students Educators in the future of Alum Rock schools this board has two seats up for election in November and we as a community will need to make wise choices about who we trust to make decisions that place our students and Families First our arusd community works best together we hope that you'll join us we need parents families and community members to be involved in making decisions we need strong ethical board governance that is focused on students and responsive to the needs of the community thank you that concludes our presentation thank you miss singolani and miss de Leon before we go any further I just want to recognize not only the work of the committee but very clearly the passion um you know as a community we obviously we

072don't always degree agree on on the direction that we go or the decisions that we make but I think the Common Thread that that unites us is is for the most part is the passion that we all have for what we want for this district and this community and uh you know I acknowledge that very clearly in Miss de Leon's presentation and and also miss singulani I know to be very passionate as a parent and as the the leader of this Committee in their work to to try to get this done so before anything else um Mr Gill so again thank you both um ladies for the presentation Mr Gill do we have any public comment on this item none okay um so uh trustees do you have any questions or comments regarding the presentation

073and trustee Quintero I'm not sure if that is a request for a comment then you can go ahead and go we'll start doing double duty there uh you know thumbs up to the presentation as well as okay as requesting to speak um I first of all I want to thank uh the committee for the work that you do uh and uh in in this capacity of being an oversight committee for the bond program thank you for that I also want to recognize the presidents of the rasa Historical Society there at that visit I I think I saw a board member of the Russia Jose Dr Ramon Martinez in those pictures and so it's great to see this collaborative effort of trying to catalog uh the artwork that's out there in our community um and I

074I completely understand the passion that um that some of the board some of the presenters exhibited uh you know it definitely hurts to see the building in the state that it's in um unfortunately it was far from a quick uh paint job in a fix-up um I I used to go to those meetings as a staffer uh for um for um County supervisor shirakawa and Chavez and uh and actually that's where I first met Karina all right we were in a breakout session for uh mayor's guide prevention task force meeting and uh you could actually smell the unfortunate uh you know it was not being kept up well you could smell that there was a there had been some leakage of pipes unfortunately in the location and so um there was a lot of deferred

075maintenance so when you see that number it speaks to that unfortunately those last years of the organization that was holding on to the building were not its best and they were not in a position to fix up to do proper maintenance to the building so uh with that being said I I want to express my support towards making sure that that building is a is an asset for our students for our community um I know that we were looking to build uh gyms while we already have access to one there and so it is my desire to see that that is a facility that's available to our kids here in Alum Rock and so um thank you for all your work once again and then those are my comments thank you trustee Herrera Loretta and

076then trustee Marcus disappeared I'm assuming she had a comment she was asking to be unmuted so potentially after you will go with trustee Marquez go ahead trustee yeah thank you so much uh Alison Floyd and the rest of the committee um for doing the work for you know working so diligently to bring this information to us um you know floor in regards to your emotions I'm there with you you know I spent a lot of healing moments there um with children with youth with parents and Community um and you know as as uh Andres mentioned with elected officials as well coming together to make our community better so I look forward to you know having that you know come about again um and as Alison mentioned you know nine million dollars is a lot of

077money and we get to figure it out right um if we don't have those conversations soon enough then you know we'll never get there but we get to make that happen and so um we get to figure it out and we get to um open those doors again um in a creative way uh and you know I know that we've talked about having public hearings you know special meetings where we can really spend the time um that it's is needed you know we we get emails all the time we get phone calls all the all the time of people that have ideas for this um site you know very good ideas and we all have great ideas for the site and I think we need to come together and hear one you know one another

078out um and then also see the plans you know the night not just the 9 million dollars to open it uh but then the money to sustain it right to keep it going for future Generations um so that it never sees you know um a time like it is now and so I look forward to being a part of you know a leader in this and making that happen um and opening it up you know as soon as possible and with you know the right um infrastructure in place so that we can continue to have it open um and so you know I I know we've talked about having those uh public um special board meetings uh I know it's a public hearing um and we get to we get to hear you know we

079get to hear the people and um you know the ideas that are that are in place to then pick the best idea for our children and our community here in Alum Rock um you know and think of us first uh right um unfortunately you know I think of buildings or spaces that we've kind of let go and so this cannot be one of those we need to keep it in our community we need to keep it in our district and so I look forward to uh being a part of that thank you Allison and Flor for keeping an eye on it along with the committee um and I look forward to continuing to support um your work thank you trustee Marquez did you have a comment I did but I think I'll just wait until

080um you know what um the board members will be making their comments and stuff later on too okay I'll just wait okay any other questions or comments from the board okay I I just a couple comments that I wanted to make um is number one I think to me one of the the key points of the presentation um is is kind of the well we talked about the nine million dollars for Maxa but it's not only that it's obviously the repairs at the schools that were mentioned tonight and all of the other um facilities challenges that that we have because of the things that have occurred in the past because of the decisions that have been made and because of the external challenges in the world that we don't have any control over but that

081being said those are all the fact the facts that we have to deal with and so I agree with a lot of the comments that have been made and that how we decide to use the Maxa facility and whatever that process looks like it's going to need to be very strategic and very future oriented as trustee said the sustainability of the of whatever happens there really needs to be at the Forefront because not only the sustainability of that facility but the sustainability of the impact of its use on the remainder of the district so it's a very it's a very large conversation to have and it's a very important conversation but it it all is within a very a big picture of the entire District but I also look forward to that I I do

082believe that there is a lot of opportu all those challenges being said there's a lot of opportunity for for the community and for the district to to face the challenges that we have and move forward in a electricity in a creative um thoughtful and strategic way so so I look forward to that work but thank you to the committee for again for the hard work the dedication and the passion very clearly evident for for our children here in the district um so with that being said um no it is information only okay so we can move forward to item 3.02 presentation of the fiscal crisis management ficmat team um who am I turning it over first Dr Bauer to you or do we have Dr Bauer she's back I'm back yes uh I'm gonna turn

083it over to Mr Chang okay um Avatar if you can unmute Mr John Von flu and Miss Julie o'ville um and also give them the ability to share their screen um they're going to be the ones who will be starting the presentation um then at the end the districts will have a response and then we'll have some time for questions thank you actually can you hear me yes yes okay and you can you see uh the beginning of the slideshow screen yes yes excellent okay good evening president barano the members the board the um Alum Rock Community superintendent and staff I'm Julie auville and we also have I also have with me um John bonfu we are both um staff members of thick map the fiscal crisis and management assistance team and we performed a

084fiscal health risk analysis on the district but before we get into that I wanted to show you uh to talk a little bit about mcmad who we are and why we aim to do this work so we were established back in 1990 by legislation to help local educational agencies Lea comply with fiscal accountability standards we provide management assistance fiscal Crisis Intervention and other services to Lea School District community colleges Charter Schools County offices we are an external independent agency of the state in other words we don't report to anybody at the state we have our own sets of working strategies and that we report next John next slide should be there okay um the 19 18 19 the state budget act uh added a little more prevented service for us to and there are certain

085conditions that trigger that uh intervention and those five upon yourself uh fiscal health risk analysis to determine the level of risk for fiscal insolvency so next block and John that one that one's yours John um muted good right now on flew okay now I can immute okay sorry about that um so Vic Matt's engagement as triggered by the conditions that Julie just mentioned um built upon the County's oversight the county uh superintendent has oversight um of the fiscal oversight of the district and this process the process of being proactive builds upon that because uh the Department of Finance and the legislature asked us to engage under these conditions uh they've given us some funding to do so and so there is no cost passed on to the county office or to the district for this

086analysis as stated by Julie that uh the one of the triggers is three consecutive qualifieds well Alum Rock Union School District had qualifieds for the 1718 1819 and 1920 first and second interim reports so six consecutive uh qualified certifications they also had conditionally approved budgets and in 1819 had received a disapproval from the county office in their budget so you might ask why has uh why did we delay so long in engaging with Alum Rock well the county office every time each and every time at the certification I was in contact with the Santa Clara County Office of Ed and they expressed confidence in the district they knew that they were working closely with the district um and uh and you were working closely with them they also had a fiscal advisory team established at

087the district so while you had six consecutive qualifieds they convinced us to delay our engagement and that's why it took us we didn't engage after three qualifieds um next slide thank you so fikmat developed a little bit about the Tool uh figma developed the fiscal health risk analysis tool based on our 28 years of experience in in different issues that we found uh in districts of risked fiscal insolvency the tool has over 135 questions 137 to be exact in 20 different areas as well as there's a uh 18 of the questions indicate material weakness so are are elevated in weight uh each of the questions are way better weighted and the areas are are based on a high moderate or low risk assessment when we come to the total risk score anything considered over 40

088percent is considered high risk moderate risk is between 25 and 39.9 percent and low risk is below 25 percent but I won't also want to point you to uh pages eight and nine of the report and eight and nine of the report there's two different sections a budget and fiscal status section and a material weakness section if you have conditions evident in those areas it will elevate your your score above the percentage level and you'll find that is is uh the issue here with alumra so looking at Alum Rock in particular we visited Julie and I visited the district virtually because of the covid uh pandemic on the first uh four days of June of this year uh we conducted interviews over four days and reviewed various documents and financial reports provided by the districts

089even after our visit we continued to review and analyze the documents um and our our report identifies a fiscal risk score of 37.2 percent recalling back what that would be on just a score alone was moderate risk however uh the score also identified some issues in the budget and fiscal section again page eight and the material weakness section page the bottom of page eight and nine which elevated the risk to a high risk of fiscal insolvency hopes I'm not getting overviewing the uh the summary of responses I want to remind the district that fitment works on the deficiency reporting method so we we focus in on not all the good things that you're doing but the things that we find as deficient and so with this summary of response and overlooking this I want to

090draw your attention to the 56 nose deficient areas and in further as we talk about this and look at this looking at the areas such as budget development budget monitoring where there are significant no's in the areas um the certain category areas so budget monitoring and deficiency cash management contributions and transfers area the deficit spending facilities fund balance general fund and non-voter approved yeah we will talk more about talk more about them so with with regard to the report these are the major risk factors the areas within the report that we found to to come to the the Forefront and as you can see by the little uh symbol there there are several of them that came into the material weakness section and the next slides we'll talk about each of those areas so you

091can get a flavor for what we found So within budget development and adoption we found that this and remember all of these findings are based on the 1920 stack Nano report that point in time okay so that particular report found that the multi-year projection included other adjustments so for the the 1920 year that was about 4 million and 1.7 million in 2021. I'm sorry 4.7 million 2021 and 1.7 million in 2122 the Assumption of the 4.7 million was based on uh reduction of 30 uh certificated ftes and administrator FTE and two classified ftes however we were unable to find board action related to those reductions because we're talking about the current year we're studying in so the board would have made that action back in March of 2020. and the Assumption attached to the 1.7

092million was related to a reduction of 20 certificated FTE and an unspecified reduction of 517 almost 5 out of 18 000. uh another concern was that the district's budget has not been approved unconditionally for the last three years and a 1819 budget was disapproved uh the third item within the budget and development in the area was that the district uses negative Contra expenditure accounts within its general ledger on next slide uh budget monitoring was the uh the second area that concerned about uh our comparison of actual revenues and expenses as of June 19 showed that some account lines were over expended uh budgets have been provided to the board in your adopted budget first and second interim reports for all of the three years 17 18 19 and 1920 however they were not present in

093the third interim report that report that uh ends as of May 31 you get it usually beginning with June uh the district has not addressed the deficiencies that were raised by the county office and its oversight letters such as concerns raised 15 18 19 and 1920 balance sheet accounts were not consistently reconciled for 1920 and lastly in this area the district 1718 unaudited actuals were not approved by the board until October the 11th 2018. that violated a Education Code which requires that baby um approved by September the 15th uh also the district's 18 19 third interim report was not reflected in the minutes of May 9 2019 meeting where it was to be presented so next slide in the area of contributions and transfers the district we found that the district lacked a board approved

094plan to eliminate reduce or control contribution and transfers from unrestricted general fund to restrictive programs and keep in mind contributions represent resources where expenditures are exceeding revenues thus requiring a transfer of contribution from the general fund in other words they're overspending in that particular resource um we found that contributions had been growing over fiscal years and uh 5.3 and contributions um from 1718 to 0.9 2018-19 special education in one particular area was had the largest increase that we saw 93 percent from its 1819 contribution now oweing contributions signals growing expenditures and a lack of attention to controlling them is one that's not just the list of reduction ideas that's presented to the board by the CBO or the superintendent those can't that can be a fortunate but it should be a holistic sort of that

095the government board approves and the governing board um follow in order to effectively reduce expenditures next Slide John just as suspended that was an area that the county office identified and it was an area that we saw that needed some attention um the second interim report projects deficit spending in the current year and both for the two uh subsequent physical years now the unrestricted side of the general fund uh projected deficits 0.4 million in 1920 2.2 million in 2021 1.6 million in 2122 and again there was not a plan approved to implement uh in order to reduce and or eliminate or eliminate spending to ensure fiscal solvency next slide fund balance and reserve for economic uncertainties um your requirement is to represent and the second interim report did predict that the district could maintain their

096three percent minimum Reserve in the uh for the current year in two subsequent years however that was based on the assumption that the district can affect reductions and that we talked about those earlier 4.7 million in 2021 and 1.7 million and 21 22. now your adopted budget shows that those reductions change to 4.2 million for 2021 so there's a slight reduction there but a very large increase uh to 17.9 million and 2122 and 22 million and 22.23. now um I want to point out um that there's a a error in this slide it's the 1922nd internet report so that first bullet point has has an error in the fiscal year but um it with regard to seeing that large increase for the adopted budget um it signals that reductions um have are being put off

097so for example if you if you're looking for a ten dollar decrease there's an option to if you're spraying it over three years you have three dollars and 33 cents that you have to reduce in each of those three years if you choose to put that off for two years you're looking at a five dollar reduction in two years it you wait until the third year that becomes ten dollars so again the sooner you deal with the reductions the smaller they are and you're able to spread them over years as opposed to putting them off and and then they they grow large and sometimes they reach a point that the magnitude um is overwhelming so we want to try and avoid that next Slide John in internal controls and prod fraud prevention um the district

098had not completed clearing accruals as of June 19th um which is well beyond the first interim report which is when we normally recommend that that be accomplished the district lacks a documented process for collecting reports of possible fraud and for ensuring reports are appropriately addressed and the district also lacked an internal audit process next slide next that one's yours John got it um so in the area of non-voter approved debt and risk management um so this is a debt at the district and the board has taken on and outside um the district has taken on uh debt in the form of a cop certificate of participation this is essentially a loan taken out by the district um as of July 1 of 19 uh reports indicated that there was 22 and a half million dollars

099of this debt on the on the books for Alum Rock and it indicated that they uh way that the district was going to pay off this debt was in utilizing fund 21 is Bond Fund fund 25 is capital facilities or some people know it as developer fees and fund 35 was just County school facilities funds typically this is funds from the state but can be from other sources as well in reviewing those three sources we found that the measure I bond is currently unissued not available for access at this time Revenue estimates for the fund 25 or Capital facilities appear that they aren't pulling in sufficiently as needed to make the debt payment on the cop and uh fund 35 has a balance of 576 um thousand and a little bit more than 576 000

100which is clearly not enough to uh to last long with the 22.5 million dollar debt um and there's no additional Revenue anticipated for that fund so it's a little bit worrisome on the on how they're going to pay uh the district's going to pay back that debt um on those sources at this point in addition figment uses outside opinions and reviews um to to in our analysis of the district and I want to point out too uh one is a downgrade by Moody's in June of 2019 they reviewed the district's credit rating for both their cops and Geo bonds and downgraded them in 2000 like I said in June of 19. in addition in 2000 September of 2017 s p Global ratings downgraded the district's bonds and they indicated in those reports several reasons for

101their decision to downgrade um and so we indicated that and considered that in our review in addition the district maintains a fund 67 for their self-insurance and while they have a positive position they don't have an Actuarial evaluation evaluation and this is necessary to support the premiums charged and the expected costs and liability of providing the insurance so it's important to have that outside opinion and review of that insurance so that you you ensure that you have are collecting the premiums to cover the costs outside of these uh the opportunities uh the annual payments of the cops would be a burden on the unrestricted general fund and that burden would exceed two percent that's our um our indicator that is it is a burdensome um payment um and so that the cops payment would exceed

102two percent of the unrestricted general fund revenue for the current and two subsequent years so in summary uh one who uh highlight a few things the growth in the amount of reductions that's straight to the district uh to maintain its three percent minimum reserved and which would indicate a positive certification is worrisome um as Julie previously stated delays and reductions compound the district's fiscal issues so the longer you take to make these cuts the the bigger the cuts have that have to become to realize if the district cannot achieve these cost reductions continues to spend more than it receives not only will it because it depleted its budget but it will depleted its cash resources and that is the concerning part because that's when you become fiscally insolvent when you have the inability to cover

103your your fiscal obligations with your cash available the risk factors described in the fiscal health risk analysis will require the board and administration to continue to make and Implement difficult decisions failure to access quickly and decisively may result in fiscal insolvency the consequences of becoming insolvent have been severe result in the loss of local control and governance the district must continue to work closely together and in partnership with the Santa Clara County Office of Education it's the district's responsibility we mentioned this in the summary but I want to highlight this is It's The District's administration's responsibility to provide the board with sound information to make informed decisions But ultimately it's the governing board who is responsible for the district's budget and fiscal solvency are there any questions Julie you have any comments additional comments no

104I you you wrapped it up what I was going to say so hope okay um so thank thank you for the presentation first of all um and I think the staff was going to have a response but before we get to the response um just from board members are there any questions or comments for um for the present presenters of the the ficmat summary and oh by the way I um we just we muted everybody's microphones by default just because we're getting a lot of feedback and background noise so when you want to speak just do whatever to to get my attention and and we'll unmute people's mics um as they speak so I see trustee Quintero I believe a request to speak so we'll go ahead and start with trustee Quintero all right if

105we can unmute him or does it need to unmute himself no I was I was just allowed to I mean um I'll reserve my comments till after I hear the response from our staff okay thank you any other specific questions or comments for the presenters trustee Chavez I kind of would like to ask questions after I hear the response from um staff as well okay so why don't we we'll hold off on questions to staff and or the presenters and um if you can have I believe Mr Chang provide your response and at that point after the response we'll do public comment and then we'll do questions and comments from the board so Mr Chang I believe you were you going to present the district response yes yes I will uh can you hear me

106yes do you need the screen uh no no I don't need the screen um thank you for president um first of all we did provide a writ response that's available in the board book um but I do want to take an opportunity to read that response uh just for the records first of all the district would like to thank the ficknet team for their professionalism and collaborative effort in conducting a fiscal health risk assessment or analysis of the district the district will be will take into consideration uh the results of the court to ensure that fiscal solvency of the district um the figma shra reports noted major risk factors in the following area number one budget development and adoption number two budget monitoring uh number three contributions and transfers number four deficit spending number five

107fund balance and reserves for economic uncertainty uh number six internal controls and fraud prevention and number seven non-voters approve debt and risk management the district would like to take this opportunity to provide additional information to mitigate the concerns in the areas noted previously in the areas of budget development and adoption budget monitoring contributions and transfers uh transmission spending from balance and reserve for economic uncertainties the district's Administration has been transparent um in recognizing and informing the board of the need to make reductions in order to keep the district solvent um such as self-certifying its budget with a qualified certifications uh since the 2017-18 fiscal uh fiscal year budget cycle uh moreover the board has taken some some significant and difficult situation or actions in order to keep the district solvent some of those actions included

108uh include but not limited to the followings number one in December of 2018 the board adopted resolution number 20-18-19 a resolution establishing agreements between the governing board of the districts and the Santa Clara County Superintendent of Schools regarding necessary revisions for compliance with statutory budget requirement and injection with the local control accountability plan this resolution requires the districts to provide monthly updates for an entire year to the county office event on how the district is compliant with the recommendations and and any necessary revision by the by the county office events um number two starting uh with the 2019-20 fiscal year um the board implemented um the supplemental um Employee Retirement plan known as serp um number three uh for the 2019-20 fiscal year um approved a reduction of 51.1 ftes in Array unit uh six

109ftes and certificated management two ftes and classified management 21.8 ftes in CSEA unit and six ftes in the team series Union for a total estimated Savings of approximately what 7.7 million dollars number four uh starting with the 2019 25th school year approved the reduction of work hours from eight to six hours per day for cert classification of the CSEA unit for estimated support estimated savings so 340 thousand dollars and number five for the 20 the 2020-21 fiscal year of proven reduction of 8.21 ftes in classified staff for an estimated Savings of approximately six hundred thousand dollars in conversation with the fake math team as noted in the presentation district District administration was informed by sigmed that they had sought to conduct um the fhra in previous years but was persuaded not to do so by

110the County Office of red noting that the district has made significant process on the monitoring process uh this is uh supported by the county of Boston Red uh approving the district's um 2020-21 budget which is this year's budget uh without any conditions for the first time since 2016-17 fiscal year budget cycle the district's Administration is committed to continued identifying and informing the board regarding budget issues and challenges and providing recommendations in order to keep the district solvent in the areas of internal controls and fraud preventions and non-voter approved debt a risk management the district has corrected all reported audit findings from the most recent prior to audit noted on page number 11 section 1.4 of the thick Med fhra report uh the district has successfully transitioned to sccoe's financial and payroll system also known as

111qcc addition to district has implemented the position control system in qcc these accomplishments will assist the districts with receiving additional support and oversight from us from County Office of Ed and implementing best practice within the district's operation that includes uh that concludes the district response thank you okay thank you Mr Chang so before we go ahead with the question the comments from the board we'll go ahead and take any public comment on either of the presentations or just specific to the item so Mr Gill do we have any public comment on this item yes sir there's one okay um so who is the first person Veronica hey Veronica when you begin speaking your two minutes will begin great thank you so much um thank you so much Ward and thank you um to the presenters

112and for going through everything um I am definitely speechless I went through the war book and I tried to you know really figure it out all of it and I thought I had something down right and then just going through this presentation just makes them more real and it's devastating it's devastating that um I don't know I I don't know where to turn as a parent I don't know right um because it's just like are we are we like closer to closing schools and keeping them open right as in closing the whole district and I don't know and we're still talking about installations of other things that don't need to be there I understand our facilities need to make sure that they are in compliance and I want to make sure that and we also

113have yeah but we also need to put a concentration and higher concentration how we can get those funds and one way I think is making sure that the district is putting out about endorsing prop 15 and I know that there was a resolution and endorsement for prop 15 that was out there and we need to do more we need to make sure that prop 50 gets approved and passed because even though it's not going to solve all of our problems it's definitely going to bring some money for our students but not for the deficit the deficit I think it's definitely that is true uh superintendent Dr lady about to figure out how to bring that money in and as well as to the government board but again we need to make sure that prop 15

114gets passed and we need to Advocate as a whole District as Community as as just individuals as well so please please we this will not be happening this cannot be still happening and our classified staff shouldn't be always cut let's take a look at Administration thank you thank you next speaker Mr Gill is flor de Leon you begin speaking your two minutes will begin and Community organizer I just want to say uh I was going I um thank you Veronica that you brought that up about proposition 15 and I just want to say that we are right now in all the districts everywhere with all the things that are going around we're going through hard times and our neighborhood district has a deficits of 20 million dollars there's like we know that a lot of

115unfortunately the money that our schools get comes from property tax and uh and I and I know that you know a lot of the schools are not getting the funds we we need a lot of resources in our schools we need a lot of uh uh support but unfortunately because our homes uh and the property tax are not we we don't get enough money for funding the schools you know and I think we all need to understand that uh you guys are as presenters saying and and and and spirits on the field uh you you should give and I mean I'll give an idea of what other things we can do how do we can get more funds to our district since our district has a lot of you know needs in our school so

116we need the support from the county in a way but at the same time as board members I invite you and teachers principals everyone in the different schools to work together to pass on the boys to the community that proposition 15 needs to be passed on 2020 because that's gonna bring around 9 million dollars just for alumbruck and our and uh 12 billion in in general and also for the for the Wildfire fires that are happening right now for the community so it's money that we money that we let's get to work let's see what we can do to make things better and get more funds get get more funds and and I know you supported the resolution and uh unfortunately trustee Linda Chavez didn't approve it but um but we hope that we get

117your support on on passing on the boys thank you next speaker Mr Gill Fontana okay miss fontania when you begin speaking your two minutes will begin [Music] um good evening community board trustees and superintendent Bauer um I think I I have both a question and also want to reiterate the importance of proposition 15 as well um I think my question right now is really around you know how do we um or I guess maybe this is for the ficmat team how much of this of of the cuts you're talking about are at the expense of of students um and and teachers and our schools because when I hear you know the only way to balance a budget is to have more Cuts I also hear every single board meeting about the magnitude of need that

118our families and our our students have and so I think in addition to proposition 15 which I agree with that the previous speakers that we need to get that across the line um this this November I also want to really urge the the board to continue to work with your Community Partners to think creatively about how to how to meet the needs of our students and families through Partnerships and collaborations that that have really taken off over the last few years all of us are also preparing um for uncertainty as community-based organizations moving forward but again there's just so much need in our community and I'm very concerned that when you know financially speaking when the figma teams does we need to do cuts I'm very aware that that often means you know cuts to

119program services and quality of education so I really urge us to all work together thank you thank you next person Mr Gill yes okay Miss Andreas when you begin speaking your two minutes will begin Supreme pretend the internal controls and fraud prevention um when he was giving the presentation he said that the district had not complete uh clearing the accruals of June 19 2020 which which is well beyond its first interim report it said that the district lacks of documentation process for collecting reports of possible fraud and insurance reports are appropriately addressed the district lacks an internal audit um how can we um improve this area in our district that's that's very concerning for me as a community member I would love to see more transparency on this and I would love to know how

120you as a board support this um from becoming a more positive outcome and again I'm going to deal with everybody said uh prop 15 is the way to go right now because I know that all districts are hurting and I would hate to see again classify taking the hit because as we see here it's been classified classified classified and it is not fair that this group which are the people that live in this community are always the one taking the hit on when it comes to budget cuts so that's just my opinion and my comment on this you guys have a good night thank you next person Mr Gill is who is that Jocelyn immerse okay mismatch when you begin speaking your two minutes will begin okay I just want to make a quick comment

121um regarding this and I did hear what um Brenda sandejas said about classified taking cuts and I agree I also want to point out that area has taken substantial Cuts over the last couple years I think we've been reduced by something like 50 full-time employees while at the same time the district paid out last year over eight hundred thousand dollars in in excess student class size overage money so when you're thinking about making more cuts to the to area or if that is on the um one of the lists please consider the effects that it has also if you cut too many teachers and have overloaded classes that you're spending more money than it had you know I mean that that is equivalent to about 10 full-time teachers thank you next person Mr Gill none

122no more okay thank you so now um we can go ahead and um take well first of all um I guess before board questions or comments I I think some of the questions um to the presentation some of some of the questions were specific to the presentation so I guess I'd like to give an opportunity to either the fake Matt presenters or board um board staff if they want to respond to any of the specifics brought up in the questions from the public and if you don't have any anything you want to respond to specifically then we can move to the board comments and questions this is Julie although from Matt the the report was um is to show the areas of concern that thick Matt found so if we have we had a concern

123over deficit spending how that is addressed is a district and board decision that's not something that we're advocating one way or the other in this report it's simply pointing out that that was an area of concern and that brings the risk higher which is why that score was where it was and then the ultimate and high medium and low ended up where it was so we want to make sure that that's clear thank you any other specific response oh go ahead mister I would also like to add that um some of the um uh ways to address this were to were talked about with generating Revenue um that is uh well that would be helpful um that is something that we cannot be assured of so um this is something that we yeah definitely have

124the district that has to address um and not in hopes of resolving the issues based on uh a potential Revenue Source down the road thank you Dr Bauer I just want to thank everybody for your comments I want you to know that we have been working very hard to address a lot of the concerns and we you know you you remember the the presenter in covera um we have had a a tremendous support from the county office of that in both helping us look at the budget and um resolving some of the deficiencies I also want to remind everybody that we do bring a number of Partnerships that bring tremendous amounts of money that I want to thank John for clarifying that we are not able to place those things in the actual budget so

125the frustrating part I have reported to the board for the past five six years now that we have been able to do Partnerships with a number of uh Community organizations the county the city and we have been bringing between nine to 12 million dollars depending on the year to help defray a lot of this programming that we need to provide our community because it's needed um this is a very black and white document and we are taking it that way we definitely are committed to looking for ways to cut the budget and that's why this um presentation is it's difficult because it points us to a direction very difficult thing to be made so I want to thank everybody thank you Julie and John for working with us for that snapshot in time we are

126also very happy that our budget for this year 2021 has been approved with no conditions yay and we're moving forward to really bring the district uh to a place where it needs to be thank you audience for your comments we're definitely right behind from 15 both as a district and on the individual level do you know we passed the resolution and we mean that so thank you to everybody thanks thank you thank you um anything else from staff or presenters okay so we can move to questions and comments from the board has any questions and comments from the board uh trustee if we can unmute oh there we go patiently sorry I don't know what happened you hear me yes okay I'll let my colleague Andres go first and then I'll go after him oh

127you can go go ahead and go so um yeah thank you so much for that very detailed presentation um you know being a parent in this school for over you know seven years approximately you know I've seen I've seen our district go in in you know this this wave um and you know having started as a trustee last year and making huge cuts in my first meeting um you know I know it's those hard decisions that are necessary to to have a you know a budget that um you know that just uh makes sense and where we're not in trouble right so I know at that time we were getting yelled at you know and and things like that but these are the hard the hard things of being on a board and so um

128I look forward you know to digging in deep you know into these details and maybe Ernesto you know we can have a separate special meeting um just to look at you know we're at and you know really um have that conversation with our staff um and you know I know um some of our community members you know Mill mentioned where we invite uh you know maybe Community to just be creative of how do we keep ourselves you know in a good place um and of course keeping the cuts furthest away from our children which is what we've always uh done and you know as a board member um continue we'll continue to do um you know yeah so I think at this time Ernesto you know I would like to request you know if if

129we can maybe have a special or meeting where we um just really you know look at all these details or the reports um and just continuing to create um ways of um keeping our our district in a good place um colvera you're doing a great job thank you so much you know um we've gone through a lot as a district and thank you for sticking through with us and um you know we're we're in a good place like it's not the best place um but as a district and where we've been we're in a much better place um and I you know look forward to being an even better place with passing propositions like prop 15 which I 100 support let me put my name individually behind it and as a board um didn't think

130twice you know we need to support these propositions and support these ways to bring in money for our our children and um our district so yeah that's it for now okay thank you any other questions or comments from the board okay so then we can um no no you're raising your hands so trustee Chavez you have the floor I'll wait for Quintero I'll wait for you okay so I I mean I call trustee Chavez that's who I saw that's who has the floor if we can't decide on that we'll just move on without comments um okay um move on without comments okay um so no comments from um speaker are you gonna be the last speaker uh president uh you can go ahead and speak and and but Andres was before me um so I

131yield to him if he still wants to go if not is it just gonna be you and I speaking last it looks like trustee Chavez and trustee or trustee Chavez agreed to not have any comment um because he was after her and he yelled to her look for the purposes of moving forward I'll make my comments and I'm sure the trustee Marquez is interested in speaking after me that's fine um so president Milano is it all right if I speak now uh yes yes I want to thank uh Fick Matt for the thorough overview that you provided I know that these are very difficult uh things to go through but you know it's medicine and you know medicine doesn't always taste good so um but it'll do it'll you know it's intended to get you

132better um so for that I want to thank the staff uh the the Vic math folks that came over and did an excellent job and working for our stuff I appreciate the comments as well somebody has their microphone on Earth um I appreciate the comments uh that you made with regard to our uh relationship with the Santa Clara County Office of Education then in itself I think really lays out uh the position that we're in that um while it's not ideal we're moving in a positive direction um where we identified as this uh uh you know School District that's not cooperating and that is seeking to go and you know drive itself into insolvency then that would be a problem the fact of the matter is that we've heard it from the folks that came

133in and reviewed our finances that in fact we are uh in a good position because we're working closely with the folks that look over our our finances so I really appreciate that collaborative Spirit um with regard to deficit spending you know that term is very it's thrown out very Loosely and I want to make sure that we explain that to um I'm I want to make sure that we explain that to the public that this is not definitely opinion this is referred to as a deficit budgeting Sacramento hands you 10 bucks a year and they expect you to have those same ten dollars work work their way through for three years in the future and that that's not the way that life Works uh those ten dollars they handed us last year definitely didn't go

134that far because of things like covet for example and so those are the realities that we need to factor in we also need to factor in the the very real situation that Alum Rock faces such as the oversaturation of Charters Charters that do not want to provide access to a quality and dignified education to our special needs students and so you've seen it directly from fictment where they pointed out that we've been jumping up in our expenditures and rightly so uh every child deserves a good quality and dignified education um and if in in the accommodations that they need the combinations that they require in order to get that education and unfortunately some of uh the folks out there that promise to to go ahead and and provide education on a on a Bare Bones

135budget they do that because they go ahead and they turn around kids and tell them go back to your home District well you know what Alum Rock doesn't have that all all of our kids are our home District because they live within our boundaries and so those are some of the realities that we Face here in Alum Rock we also have this concept of path dependence those of us who study public administration acknowledge recognize that uh every single line item on a budget is spoken for I mean that everybody has something that they're interested in in the budget and Alum Rock School District and rightly so everybody can look at it but if somebody has some sort of vested interest in making sure that that line item doesn't disappear and that's what makes what what

136makes those decisions difficult and you know what we need to take those actions um on they're difficult but that concept of path dependence um needs to be recognized that the same folks that are here telling us that they're flabbergasted by the information tomorrow or the next or or in the next in the next item would go ahead and uh and you know let us know how this pleases they are about the potential cuts that we're putting forward all right and so that's a very reality that we face as um a public organization a public entity that has a public budget we aren't like those privately operated organizations that are out there sometimes they actively are working towards seeing us not succeed um and I'll I'll say that and if they want to speak to that

137they can come over here and join us at one of our public meetings um I'd like to speak to the issue of the certificates of participation um it's this is not an excuse but it was an action taken by previous board um none of us here other than uh board member Marcus I believe we're here to go ahead and make that decision to take the district and put us in a in a very very precarious situation putting our our general fund in a precarious situation I've been of the mind to go ahead and use the first batch of of bond money to go ahead and take care of that uh that cops the certificates of participation because I think it's the the responsible thing to do I know that some folks don't agree with me

138but I don't want to take anything that's going to put our general fund at risk uh more than and it is already at risk by just the the realities that we face as a public organization so um you know I've I've mentioned a lot I hope that I've I've in Mike through my comments I've helped some of my colleagues understand some of the nuances as well as some of the members of the public the reality is that Alum Rock faces I want to thank um our staff Colbert in particular who has been there through very very difficult times um anybody else would have taken off facing some of the challenges some of the the issues with their previous board majority uh investigations of All Sorts that really took away a lot of the attention uh

139from the things that had to be done and and they put him doing a bunch of a million other things to respond to all those issues um that were brought on by the actions of the previous board majority so I want to thank you for that with regard to the the concerns raised about uh internal Auditors uh we used to have that position uh we subsequently went ahead and let it go once we um went ahead and uh were taken under by or our uh were under the authority of the the the Santa Clara County Office of Education so I'm sure Colbert can speak to that reality that we no longer are required to have an internal auditor and that the Santa Clara County Office of Education plays that role for us so thank you

140for uh the time to speak more president okay thank you uh trustee Marquez did you have comments or questions and we need to unmute trustee Marcus okay right there yes okay I'd like to thank um the um the team that came out to do this uh from for uh from fake mad um I can't pronounce your name Judy but forgive me for calling you Judy and and John it's easier for me um you have no idea how happy I am that you came out to do this this um audit um I myself for the last five years or four years I want to say four years a little over four years I have requested to have a forensic audit of everything and go through every single little thing because um I I have gone on

141record saying that I I am not um I have lost all confidence on this Administration and um for five years now um I have seen this District going on to deficit after deficit after deficit and after deficit and there were a lot of things that is just way too much to talk about but um the last the last figment when we went into that yes we went through a lot of Investigations um and that none of them have come out to prove anything um that was illegally wrong and those were my concern just tell me if it's anything is illegally wrong I'm a board member and I I will you know own up to it if if we have to do what we have to do well there was a lot that came out and

142mostly it was in the business department um they found out that um they we had seven cbo's interim all interims coming and going coming and going coming and going and um that was where the whole problem I think originated right there because our books had not been reconciled and in this report you also um mentioned that in 2020 or 2019 I can't remember I don't have a copy of your report um there was also books that had not been reconciled now we cannot do business when the books are not reconciled because we don't know what kind of money we're working with you know that's just simple Logic for everyone um your husband gives you 500 for the month then you watch your pennies and that's all you can spend you know so um and you

143check to see how much you have got but I remember going um and asking can we afford this when we go into negotiations can we can we afford this yes but we have to tighten our belt in three years this is what I you know I was told like about 18 months later we then get a notice that we are 14 million dollars in deficit and I go how did we get to 14 million dollars deficit an answer that has not a question that has not been answered and I've been criticized for asking how we got there well because I'm basically cons you know uh obligated to ask those questions and so a lot A lot has happened I like your report because this is coming from you guys you're not from you know you

144don't you don't answer to the state and I realized that you don't answer to the state and and yet um I I I didn't quite get what you said that the county um the county I guess calls you or looks for you when we have gone three years in a um in a a budget that has been disapproved or have been consecutively uh qualified for three years I wish it had come here after the three years and not waited for 16 years and we would not probably see the deficit that we are looking right now in 2022 we could have done something we could have stopped it the letter that strikes me from the county office because we have been under them and I question why did the county not see how much deficit we

145were going to be going into 2020 2022 and why did did it keep they allowed it they should have stopped us and said in 2022 this is what you're going to be looking at oh that would have perked my ears and said oh no we can't do that so that that information that we got pretty late um it cost us a lot it costs a lot we lost libraries to our children every librarian Art District and 25 schools were closed the lowest pain there was not going to bring much money to a 14 million dollar deficit but the letter that strikes me back and I keep thinking about it was the one the County Office of Education sent to us and said they have a concern about Staffing now I have family members that are

146superintendents in in other school districts up in the state and I have lots of friends that are superintendents they were following us and the first question they had asked is did you find any close schools did you consolidate schools no that's not happening yet and he goes I don't know you better you better be prepared and yes Charter Schools were just knocking at the door waiting to take our buildings but if we could have given them the charter schools we don't have enough children to sustain 25 schools I mean we were looking at middle schools with only 200 190 students in in a middle school that that can hold 800 students I mean it this was drastic you know and I would have closed schools so that we would not go into this deficit school

147and yes the the charters would have come in but they would have come in under our we would have given them the charter we would have overseen them and if they weren't doing a good job or any better than what we were doing yeah we could hold them accountable we could have worked something out at least showed the county there we're going to do Staffing because we're going to be consolidating schools because this population that was at ten thousand today we're at 84. enroll student enrollment here so yeah there are a lot of problems here and the in your report the very last thing it says it said the one I saw that um you know that if we don't take care of this that it can go basically into receivership and we would be

148losing a government you know or or we cannot be governing anymore I for one I'm telling you the figma team would gladly give that up and have the state come in and look at what we are doing here because death is a different deficit things were being done that never should have been done I brought them to the attention yes the three vote of La the times in the past keeps being bringing up but what about the three vote that's here now that I have voted against these Cuts because there were other ways to cut where it was really going to give us more funding not just drops in a bucket I was going to look at that I would say we still have a chance not to go this direction but the looking at

149Staffing let's look at Staffing and see how much we can get out of that I don't have the vote I'm not part of that three vote I am not part of that three vote so I didn't create this one and yet look who we are now I have lived here and worked here for over 50 years I I invested I invested in here I I have grandchildren going now and all my all five of my children went through here so yes this is close to my heart I am not here to go on to city council or anything but your report hopefully we can get people elected that are not going to come in just to use this as a stepping stone but we have folks real problems and you just named them to us

150you just name them right there and you put them in black and white you know and I want to thank you profoundly for that and I would like to know how I can get a hard copy of of your report because I need to refer that back to him when I do not support some of the recommendations that are going to be coming and I'm going to say see this report this is why see this report over here this is why I want to say this is why I will not follow those recommendations that are before us so um thank you again very much and um again I I don't know how to say thank you with um with all the information that you gave us thank you okay thank you um in the interest

151of time we've had several presentations tonight and I know we have more coming so I'll just make my comments brief um I I thank my colleagues for their comments and and very very thoughtful comments you know I I do appreciate when we can disagree in our viewpoints or our perspectives and do so in a respectful way in a way that that helps us to move the district's form District forward and give confidence to the community that we can can work on things and and work on Solutions and not get mired in in some of the things that sometimes trip us up so so I take that as a positive I think um certainly I think it's it's well known and it has been well known that there are difficult decisions that we have made and

152and I mean just just quickly speak to the three vote quote unquote three vote currently I mean a lot of those decisions that we've had to make as the current three vote that's quoted have been cleaning up the the messes created by the previous three votes so so you know that you know not everyone gets everything right all the time but we've had to do a lot of cleanup um and and decisions have been made for that reason by that three vote but I think certainly there are still difficult decisions that are going to need to be made very difficult I would venture to say way more difficult than what we've had to to make decisions on to this point um and those are I mean I think we all need to prepare ourselves for

153that those are are going to hurt at many levels um as much as it hurt to cut Librarians and reduce um you know our Liaisons and all those things that we should expect that and I would imagine more given the reality of all the external challenges that we have with the current environment so that that's one thing is is you know I think we need to prepare for much more difficult decisions to come and those decisions need to be made I agree with a lot of what's been said we can't um you know we can't tiptoe around some of these things at this point we need to we're going to have to put our foot down and and I appreciate the one thing I appreciate about the presentation from fake Matt is that and I

154would like to even learn more about is that concept of the longer you wait the more difficult it becomes so so these decisions to either decrease spending or increase Revenue are are very time sensitive it's not something that should drag on for months and years and we shouldn't get stuck on all these other side things that we sometimes get stuck on with such crucial decisions to make so I'll end by saying you know the decisions to potentially coming that we may need to make to decrease certain services or whatever it may look like those will be hard but I think the flip side of that that we need to really focus on is how can we be very strategic very thoughtful very long-term focused in how we can look at our Revenue look at the

155money that comes in and be creative and Innovative and and think about in addition to the propositions that may come our way or that are in front of us now what other opportunities do we have to begin to chip away at these issues these challenges that we have so so I would I would just present that as as a look forward and not so much reflected on what has happened to this point but what can we do to start being proactive about addressing these challenges at this point so those are my comments um so we can go ahead and move forward to um trustee Chavez you did want to speak after all but it's an invite what's that it's an invite oh go ahead I would like to invite the the team to a budget

156committee meeting in October and if they can make their dates available because I think we need to hear what they have to recommend to us to make what the cuts that we have to make to make the decisions that we have to make easier smoother if we're not more knowledgeable onto what they believe that the boards would also be doing can I ask a clarifying question when you say the team what team are you referring to oh they they referred themselves as a team so the fake map team that's oh yes I think that may have been addressed by Miss Avil a little while ago but if we can open up their mics just to address that question if they can come to the but to the budget committee meeting and we can work around

157their dates that they would be available and if uh we presented on both of you and I were on there and I mean and if they agree I invite the public as well to the meeting if they could set up a time and date that's convenient for them in October I think we should do it sooner than later I don't want to do it in November I would like to do it maybe the first uh week of October if they are available I'm sorry if I'm mispronouncing and then you've got the name right you've got the name right um our job with regard to this report was to point out the deficiencies in areas that cause risk and so one of those risks was deficit spending so it's it's not our um position we we

158didn't do an analysis such that we could give you recommendations for reductions we are simply pointing out that there is a risk with regard to the level and the length of deficit spending that's happened at the district thank you uh yeah trusty Marquez and can I be next yeah go ahead trustee Marquez and I'm sorry trustee Chavez Okay so she said that they don't do the recommendations but do they have the person that does do the recommendations or best practices that should be followed because I'm sure they've worked with a lot of different districts throughout the state if I may uh comment on that the intent of the legislature and Department of Finance in um assigning us to do this proactive work uh was to assist in identifying uh issues that were commonly found in

159districts that are uh in fiscal distress um this is to be a road map for you to look in different areas to work again with your county office um as uh said it's it's part of the fiscal oversight that the county office would work with you on if we were to engage in a into a greater degree than what our review of the fiscal health risk analysis we could do so but we would have to engage in a different uh project or a different um work study and we could develop a scope on that and it would be at a district cost okay um can I speak trustee uh yes um I think sometimes you have to spend money in order to get everything in order so I I think that maybe we should ask

160whatever their fee is that you know look at it as an investment to to make the district run better so can we can I ask them that this be a follow-up for staff because I don't know that this is something that we could do at this time in this meeting but certainly something that can be followed up with staff to look into is that would that be uh and if we can also include scoey in in the uh meeting so that we could hear from them too what their recommendations are directly uh from them okay um trustee Quintero I saw you I think I saw your hand and then Dr Bauer I can't tell if you're trying to swat a Nat or if you have you're trying to be unmuted oh okay so uh Mr

161Gill can we unmute Dr Bauer and trustee Quintero was that you raising your yeah okay and so and also just you know we'll we'll entertain a little bit more discussion on this but then we I think everyone's opinions have been set forth and and we'll try to hopefully my colleagues and we can try to wrap it up so we can move forward all right got a couple quick questions for general counsel some of the comments that were made said that the investigations uh into particular the the the contractor that my colleague Marquez as well as uh Karen Martinez and izorer and uh contron um were supporting uh in the 2016 contract that those investigations didn't yield anything and that they were just you know nothing and so our general counsel actually reviewed the uh information

162that we received from the District Attorney's office and I would act I would ask if uh general counsel can clarify as to why they weren't able to move forward on some of the things that they did find and so that's a question that I'd like to post to general counsel or president where a response right now um yeah responsible general counsel with regard to the the DA's uh findings and why they weren't able to move forward if you could just um I don't know if that's possible Mr Ruiz for a quick clarification and then if so we can move to Dr Bauer after that sure just very quickly and without you know going into any detail because that is the subject of pending litigation between the district and deltera but as to the District Attorney's

163findings he did find that or they did find that there was criminal conduct um back in uh in connection with the 2014 agreement but there was no query there according to the district attorneys uh release an internal memorandum there is no criminal prosecution on that uh only because the statute of limitations for criminal proceeding has lapsed already okay thank you uh Dr Bauer I believe you wanted to say something just wanted to remind the board that we can get direction but let we need to start um not talking about contracts with other agencies this is not the time and just friendly reminder for everybody thank you okay thank you okay um so the last brief one trustee Marquez and then we'll move on go ahead we can unmute trusty Marquez thank you for recognizing me

164a second time I honestly didn't think that you would go there but I appreciate the fairness that you're doing this tonight so thank you um in regards to the last comment um and naming the ex people that were here so long ago except for myself I'm still here because Andy keeps voting me in um that's the only reason why I'm still here because the community keeps voting me here but um there was no need to go back there because there is more to what was set here tonight it was there's a whole lot more I'm not going to go into it is this embarrassing it's behind is moving forward you know um that it you know the time you know lapsed and they they didn't do anything at that end I just want the team

165to know that the D.A held that for three years so it could have been done and they looked at it and I guess it just they decided not to go I don't know why they decided not to go with it but the outcome is what we have to look at they did not go with that and instead of leaving it there and starting again this is why we don't go anywhere and don't move forward because we have board members like Quintero that keeps going back to the past keep dragging us back there instead of just moving forward so as the team I just want to let you know that just that's just the way this board has been functioning and I apologize so thank you okay thank you okay so with that I will thank

166everyone for their participation um on this item and we will move forward to I believe one of our modifications was that correct this was 3.02 right yes so item 6.10 was one of the modifications to move after 3.02 which is District energy saving solar power agreement follow-up um so this is an item that it's informational there's no action on it other than um I along with some of the conversation that we've had tonight it ties in really well and I and I thank um my colleague trustee Marquez for for actually moving it here because I think it fits really well in um when we've had this presentation from fake Matt and the challenges that our district has and what I not only I but many others that I've heard support from at this point from

167the community feel is a a wise decision to look into the possibility of a of a solar energy program and so with that in mind what I um I'm going to I wanted to request the staff with this item is is to have a a study session specific with this specific item so that we can be very transparent with the community and with stakeholders about the potential benefits or the risks of a program like this and I hear feedback of some individuals who say that you know you know we shouldn't focus on this saying we don't need this and there's other things I certainly understand that sentiment I'm of a different opinion and I I believe that I've heard sufficient support from community that thinks that this actually is a very important item because it

168it it puts out there the possibility to address these huge issues that we have in front of us the proposition is is one one road that that we definitely need to go down but also this is another Avenue I think increasing your the your streams of Revenue is is something that we should that we should always consider and this to me for that reason is significant so I wanted to put on uh a request to to staff to to arrange a study session for that and it could be in conjunction in my mind with some of the other requests that we've heard tonight as it relates to budget um I think this it's a bigger picture discussion um that that maybe we can formulate a staff can formulate this meeting in such a way that

169we can address the bigger picture of budget um and I know Maxa was thrown into that discussion as well as but as well the the solar program as as an item for for further um study and and transparency so that was what this item was put on here for are there is there any public comment on this item Mr Gill there is one Veronica okay uh do we can we get the clock up mighty bad okay thank you so when uh you begin speaking Veronica your two minutes will begin [Music] thank you and um you know trust you I don't know I do appreciate you bringing this again about the solar panels um but I also and it is something that I think we should look all forward um you know as we are seeing

170even more of what um what are our whole ecosystem is going through right um but I also feel like there's also important things that we need to and that need to be addressed before we move forward with this um as much as I want this I want to make sure that our roofs are you know are done correctly that are the the lunch um the lunch cafeterias have appropriate uh things that they need before we go on uh on on talking about the solar panels and you last time that we talked about this was last month and the previous month before that and you say you wouldn't you were not going to bring it up until October so I'm not sure why we keep bringing it up over and over I was really looking forward

171for October to for the staff to show more um but I'm not sure why is that consistency and maybe you can answer a little bit more of that consistency to bring it over and over every month and again I'm not opposed to it um and I I'm definitely looking forward but I just want to know more about the consistency I also do want to address um trustee pintero um I found his his comment being kind of just you know kind of very disrespectful saying that um it is the same people that come and just um are do not approve anything of what is being done right and it is because as I care I have two children in this district and I was an alumni as well and I care and the system failed me

172and I'm not going to let that system fill my children fill my children's friends and fail my community I'm not okay the district failed me and I'm not going to do that and there's a lot of people out there that are not going to do and willing to do that so um please um I'm bringing my passion and I hope it gets respected as I respect every one of you thank you thank you Mr Gill next person flor de Leon Miss de Leon when you begin speaking your two minutes will begin uh good evening everyone uh again uh so I just want to be very brief and uh um and I don't know anything about the solar panels but just uh keep in mind we have other priorities that we need to focus and maybe

173start getting studied on that like the AC you know and other electrical problems that the our facilities might have that are priority that you guys need to oversee everything what's going on in the schools and prioritize and and I understand solar panels will probably be doing savings but sometimes uh the insurances uh leave you the solar panel to to belong to you after so many years when the they need more reparation and I don't have a lot of information I'm just saying that with what I have heard about solar panels but um just keep in mind we still have schools that need the AC and ask the schools what is what they need and help them to uh uh with their infrastructure thank you next person Mr Gill Brenda zendejos okay miss indejas when you

174begin speaking your two minutes will begin hi good evening board members and superintendent um I just have a quick question um I'm fully supportive of the solar panels I can't wait to get these in our schools because I do believe that they will save us a lot of money in our school and that will provide money for um you know other things that can support our the quality education of our students however I just have a question maybe um I don't know if you can answer this after your presentation um with the solar panels uh whatever company we go with um will they be covering the electrical expense because I know that our district does have electrical problems I don't know what the estimate cost of that is but in that if we do um

175do we have uh enough money to pay for the electrical outlet problems before we get solar panels or how does that work um that's just a quick question but I'm thankful that you're bringing this up and um thank you for the time that you took into doing this presentation you have a good night thank you next person Mr Gill none okay thank you so the questions or comments from the board trustee Chavez and then trustee Quintero after that okay I'm not opposed to solar power but why do we keep bringing this item back for discussion and information winning a previous meeting trustee Verano um excuse me president and trustee Quintero suggested we schedule a study session to gather information from experts in solar power because none of us on this board or staff are experts

176in this field csba uses a law firm that does a presentation titled 10 mistakes that school districts make when purchasing solar power and if you want that information I can give that to you or you can actually look it up on the csba website and this item has been on the agenda since April 2019 and we don't need to keep wasting any more time on it and I'm glad that you finally said that we're going to have a board study session on this and then I hope that we can get it uh done as soon as possible because we do need to be looking at different things but also the way the budget is and the way it was being presented before where it said no or little cost there is always costs and to

177me that was like deceptive uh writing because the you have to fix all the electrical before you can put the solar panels in so that is cost to the district um thank you okay thank you um was it who was the other person that I said Nick was it trusty Quintero I see your hand if we can mute trustee Quintero and then I see trustee yes say hey thanks uh uh for the opportunity to speak I I'm appreciative of the fact that folks are are coming around to the idea that um this is just for information um I think that's what was said at the very beginning in the first item um and uh when we went out to the community and spoke as not a board majority but just you and I we reiterated

178that this is all an effort to go and get more information to understand what options are out there so that we can in fact realize savings for the district and so um I'm glad that it's finally that we're we're moving beyond um just a note to now folks recognizing that this is just an effort to gather information to understand if there is something that makes sense I personally will not support something that is going to take us into debt something that is going to remove money from let's say um us uh spending uh on fixing our facilities and stuff of that sort so if it makes sense for us if it saves US money then that's something that I can support I will not support something that's going to take us down and put us

179in a in in any debt um so um I'm glad that uh it seems like we're we're getting around to the idea that uh this is just a search for information the staff's going to go out there look for options that make sense for us so I'm glad that uh we're doing this in a very transparent way that we're here at a public meeting asking for a study session to be established uh sometime in October and so we're really glad that we're engaging in a very very transparent manner to to coordinate this study session thank you president I believe I saw your hand up if we can unmute her I think she yes thank you uh just uh for purposes of moving us forward I'm understanding correctly you just brought it as information only to

180put it on for a future date which could very well be October but at this point you're just directing staff so that we can have that eventually am I understanding correctly yes is there anything else we need to do in order to move forward I do not believe so okay um I I'm in agreement with that I know that it's not on for action or vote but I think we should move forward I think we're all in agreement that we should talk about it not now but at a later date okay thank you trustee Marquez I believe I saw your hand if we can unmute trustee Marquez hello yes we can hear you all right you know folks we were just given you know a figment report of the deficit spending and the budget the

181crisis we're in here and and I for one I I want to take care of that so we could get back to the matter of students and their education their test scores you know I want to get back to what we were elected not only just to keep the district solvent but to address the children's education in this community and but you know going into a venture like so and I I told you last time I wanted to bring it back back when I got elected in 2012 or 14 something like that and uh and you know what everybody was doing it then it would have been a really good time for us and we were we weren't nowhere near the deficit spending that we are in right now and I said and you know

182what I I'm glad that you want to get all the information and give it to the community and for us to do it but you know what we got an election coming around the corner in November and the whole dynamics of this board might change and so why can't we just wait till after the election and you're still going to be here as pres as well you're still going to be on the board president gerano then uh then lead us through it you know if this the Dynamics of this board changes but to just start talking about it and then in December you know um there's going to be a new board or not a new board then start dealing with it there so that we're fully informed that it's not going to cost us

183any money like you guys keep saying so guys just just look at the figment report and that should guide us thank you okay thank you um my comments I just say that um I agree I think that that I'm I'm hopeful and excited that um it seems like people are at least opening up and again opening up to the possibility of looking into this as a potential benefit to the district a significant benefit financially to the district of course as I mentioned in our presentation that we did um outside and to one of our uh to District Five United I've stated very clearly that we need to be very Vigilant very careful very thorough entering into any contract and we know we have Painful scars um surrounding that so we definitely need to to be

184vigilant around this however I appreciate um trustee marquez's comments about listening to fikmap because I hear very clearly in the fake Matt report and in their findings that the quicker that we can resolve our issues the better it will be that the the longer we delay making decisions and and we delay you know trying to figure out ways to decrease spending or increase Revenue the the more challenging it will be for us to a point where it may become a very dire situation so so I appreciate that and I think that moving forward in this way looking into this as a time sensitive um item is is definitely following along with what what the report we got from fake Matt was and finally I would just say that in terms of the comment about the

185election I mean I'm I don't think that I think that these questions about the electrical panels and the electrical outlets and air conditioning and all those things I think that as this study session would answer a lot of those questions I feel like I have the answers to those questions from what I understand but bringing in people to clarify that answer some of those questions for people that are that are very good questions and they're valid but I think that's the point of having the study session and I for a kid sitting in a cold classroom when if when and if we come back or a hot classroom they they don't care about who's going to get elected next who's going to support or not support they just want solutions to problems parents want Solutions

186and so that's what all I'm trying to put forth if we have have this study session and if it turns out to something to be beneficial then hey let's look to a solution if it turns out that it's gonna as trusty Quince said put us into debt and be this big convoluted muddy thing then you know maybe it's not something it isn't the time if that's the case but again the point is is that we put this um as a study session item so we can learn more about it and figure out what is best for our kids right now what's best for our fiscal situation and everything else so that's my comments on it so um I think staff do you have enough to to move forward with that recommendation okay so thank you

187everyone for your comments and with that we'll move to let me get back to what um 4.01 is that correct can anyone clarify okay item 4.01 request to address the board on any item that is not agendized tonight um Mr Gill do we have any comments for public comment for item 4.01 there are two okay who's the first person okay missing the house when you begin speaking your two minutes will begin and just a reminder this is on any items that are not agenda's for tonight hi uh board members okay we just want to thank the superintendent for responding to next week on it that I wanted to um bring this to Linda Vista and get it approved but I want to thank her for the email and for the support and to get this

188moving and I can't wait uh to get this project going um and that's my only comment you guys have a good night thank you um next person Mr Gill onica Veronica when you begin speaking your two minutes will begin great thank you um Lauren again and I want to bring something in um somebody else had mentioned it in the previous presentation about the um the deficit and it was about bringing Community bringing Community Partners that Ellen Rock works with um Community I'm sorry can we pause for a time can we pause our time Mighty bad at 140 two or three just just to be clear are you speaking to one of the items that were um that are the open hearing items nope I'm not I'm just asking for an invitation to bring Community Partners

189University members into the budget meeting um and okay okay so okay so hold on hold on sorry so we'll start your clock again I just wanted to make sure if you were speaking to one of the public hearing items that we captured which one so we know what your comment was I apologize for that Interruption um can we go ahead and start it at two minutes um just because of the interruption and you can continue I apologize that's okay thank you um again I want to um I hope that the board takes into consideration bringing it a special board meeting um where um Community Partners community members parents um families and the board comes together and started look starts looking at the budget and starts um you know coming into some solutions bringing recommendations about

190what we're going to be doing with the deficit um as they had mentioned before and that's the FML team we cannot wait um and so I think we need to urge all of us to start looking for those Solutions and how we can but get that money for that deficit so um I want again I I'm calling that we rank all part all of the stakeholders into a special board meeting and start with this Innovative um thinking thank you thank you Mr Gill and the other speakers yes next is Sandra Rivera okay Mr Rivera when you begin speaking your two minutes will begin thank you board my name is Sandra Rivera I'm a fourth grade teacher at Chavez Elementary School I'm coming to you tonight with a few things the first thing is just um

191to let you guys know how extremely difficult that it is for us teachers as well as for the students to be doing all of this online classes and um having the technology it would be really helpful for us if we could get some kind of guidance on what report cards are going to look like and what the full expectation is for the students I've had lessons planned for the last three days and while they work what I think is working when I try to connect my equipment and then do it with the students they hear awful feedback and I've had to have you know it's help and everything else and out of my 16 years in this District this is the first one where I go home and I cry myself to sleep every night

192because I feel like I'm not doing the best job for the students um the second thing that I would like to ask is that we have Google accounts yet Google Voice is not set up for us and while we're trying to get in touch with parents um at all hours um during the day having to use our own personal cell phones and such because we're no longer in the classroom I now have parents that have started um abusing that privilege of having my personal either home number or cell phone number because of the fact that I don't have the school number to go through anymore so if we can try to find something so that the teachers can have the mental health of separation between classroom and our home life it would be greatly appreciated

193by many thank you thank you any other comments Mr Gill yes next is okay dilsa when you begin speaking your two minutes will begin good evening members of the board um this time and it is regarding um the presentation that upon a committee made I had my hand raised but for some reason I didn't got cold and um I just wanna I think that is because of all these two meetings is new well I'm sorry what item is this speaking to um that presentation that them is Allison and flor de Leon made okay okay so I want to talk about a Maxa especially I know we have a lot of non-profits organizations that really want to work with with the district on rebuilding Maxa I myself as a children I recall going in there because

194my mom worked two two jobs during that day so I didn't have no no safe place but Max and then my when I Grew Older my young my oldest daughter went into a head start there which was a great help because it was just walk it was a walk through my house to there and it was like a five minute walk I would really encourage this boy in that District to partnership with those organizations that really want to rebuild it and bring it up to life and actually work together for the community and for the benefit of that communities like myself and other friends of myself that benefit from having a safe place I'm sure other youth can benefit from it as well and lastly but not least this is where we're talking about um

195social emotional and help not only for our students but also for our teachers our teachers are doing a great job as much or little they have they're trying they are there my kids love the interactions that they have with our teachers so please let's find well find ways that we could help each other and um and address those those social emotional needs with counselors with one-on-ones with um something that um that this you could work with them I know we have already programs out there for for our children maybe teachers who utilize them and Miss Sandra and every teacher out there you guys are doing amazing you guys are the best that we're teaching our children have and thank you for such amazing work thank you have a good night thank you um are there

196any other speakers Mr Gill yes so there are a few next is Rocio dureno I'm sorry I didn't get that Uranus you say was the last name yes when you begin speaking your two minutes will begin thank you good evening everyone on the board and superintendent I'm actually addressing um the bonds committee report I also raised my hand but I guess it went by really fast for public um speaking on it my concern is I'm active teacher at Lucha and I have seen those leaks in the ceilings and I'm a little bit concerned hearing that it's actually a coolant that is leaking um I'm just voicing the health concerns if if there's a coolant leak how is that affecting our teachers our staff our students our parents that are on site when we were on

197site if there's any health hazard towards that um and also just concerned that all this money was placed to give this wonderful opportunity to have HVAC at our schools and to see that it wasn't fulfilled correctly so hopefully from here on we're able to make great decisions for our schools and allow them to have the HVAC at every school but make sure it's done wisely so that when we do have to go back and make any repairs we're doing it so that it's going to benefit everybody and not just in the moment but in the long run as well so thank you thank you next speaker Mr Gill [Music] and you mute it floor floor de Leon okay organizer I just want to uh use the holy comment to um to uh share the what

198I see with you guys as board members you know uh please respect the time and Presidente jarano if I was a president I will do my job differently you know uh take a lot of time and just to tell you the same story all over and it looks like we're always bringing the elections are coming elections and the voters elect me and that you know please trustee Marcus use your time wise you know try not to spend a lot of time and not only you other other trust like trustees trying to answer your your questions and and trying to fight with each other it's not gonna take us anywhere we need to listen to the teachers we need to listen to what's going on in the schools we need to pay attention like you say

199um uh trustee markets we need to start doing and getting work um while we need to work which is the education in our schools and you guys are most of the time arguing fighting Finance excuses no I didn't do it no yes you didn't know uh where all their trustees now we're doing a better job we're trying to clean up what it was done you know please Focus now forget about the past Focus now and start working on the future but please respect the time because a lot of times you go back and forth back and forth and use a lot of time please try to be very sure on your comments and respect all these people that is here because a lot of them are have to give their class tomorrow and always consider

200the time you know always consider your time and listen to yourself before you speak and I I'm learning to I'm learning to but I'm getting tired of this and a lot of parents that's why they don't like to participate to this meeting said I don't like that and I don't appreciate that please use the time wise thank you next person Mr Gill the person still raised a hand was Veronica she already spoke okay nobody else okay thank you uh just a quick clarifying question for you actually Mr Gill regarding the Google uh Google Talk the um the question about the phone uses my understanding as I know as a social worker um before we actually got issued phones um I on my personal phone that's something that I initiated on my own just to set

201up the the ability to mask my number for lack of a better term is that is the ability to do that is there a district involvement that needs to be happening that needs to happen on that or is it something at the individual level because I don't I do agree that I don't think it's appropriate um for staff to use their personal phones to make um have to make work related calls because you know there's a boundary issue there to me and I there is the the possibility of using other methodologies or methods to do that but I just wanted to ask if from your opinion is it at a personal level that staff should do that and if so do we need to train them or is it more of a district level solution

202that we need to look at for that and that could be for Dr Bauer too I guess so uh for President bairano we have already implemented a solution since the pandemic happened we waited for all of our special ed team we have done four principles and many of the schools so we informed in the sites which notify us we just enable that service for them so it's a monthly add-on service so it installs an app it is called Google one sorry 101 voice app which is from our Telecom provider we install that app and based on the recommendations or requests received from the school sites or the district admins so we place the request and there is a process they will get notified through an email email has all the instructions how to set up

203and definitely it masks the number for the classroom teachers it is similar or exactly the same number of their classroom extension okay thank you Dr Byrd is we're going to ask I just want to let everybody know that we will follow up on Ms Rivera's request okay thank you very much okay thank you everyone so we'll move forward to item 5.01 do we have a representative from Teamsters with us tonight um Dr Bauer do you see anyone or I don't see anyone I'd be able to see them okay so if we do have someone they can they can present themselves and we'll bring them back in after the fact if we need to item 5.02 CSEA is there any representation from CSEA yes we have okay um so whenever you're ready you can begin speaking

204and the floor is yours okay thank you good evening Dr Bauer and board I'm going to make this quick and be mindful of the time I just wanted to let the board know and the community know that the district and csca have reached an agreement on the mou for the return to school for the 2021 school year and how much we appreciate the district management team we worked very diligently and very hard to put this agreement together we had many meetings and we feel and I'm hopefully the district also feels that the the agreement is fair to both the district and our membership our membership has not received the mou yet but we are trying to resolve the issue and hopefully by tomorrow or Monday we can have that resolved and then get it out

205to our members and I especially wanted to take to thank Mr cernet he was very diligent and understanding our position in protecting our members keeping them safe and to to just all around um welcome he welcomed our comments and suggestions on how we could do that to have a productive school here for however long we have to stay with the shelter in place and the distant learning so we appreciate it and we look forward to many more collaborative meetings thank you so much for listening to me thank you and have a good evening you too thank you um Alum Rock administrators Association I believe I saw Miss Martinez I don't know if that's who's speaking there we go hi good evening everyone um sorry let me pull up the speech here and the video is

206on yes okay hey good evening to our school board members and superintendent Bauer uh the alamac administrators Association is pleased to share that our school sites are up and running and like one of my students parents said we can do virtually anything when we put our minds to it to support our families all School sites have committed to holding a minimum of three parent trainings on technology um for uh parents that need the support administrators are eager for our parents to be trained in learning the basics of Zoom Google classroom and parent Square in order to support their child's education and also to maintain constant communication with their school sites in addition each school is holding its own input meetings for the learning continuity and input plans and so by September 21st uh School sites

207should have held the meeting and had collected input from their parents uh speaking of communication araa would like to acknowledge our state and federal department for acquiring Vietnamese interpreters we have seen the principals and teachers utilize this resource and we would love to see an extension of this resource happening also this is the time of year where School sites are hosting or back to school nights virtually teachers are doing a great job providing sessions that are accessible to parents in English and Spanish and some sites are also using sessions in Vietnamese and finally the Alum Rock administrators Association would like to acknowledge our amazing workers in the warehouse for delivering materials and making sure our students have what they need in order to learn so thank you so much for your time and have a

208great evening thank you um area I know Josh oh there's Jocelyn can we unmute Jocelyn and I am here and I just want to say that I'm not going to be speaking tonight um so I'm looking forward to the rest of the meeting thank you okay thank you Jocelyn um 5.05 superintendent um thank you of the staff members in Alum Rock and I do want to from the bottom of my heart Jocelyn Sharon um Teamsters leadership and Tom and and um the guys um we would not have been able to do all the kinds of things that we have been able to do without the staff and I know that opening this most you know the majority the this uh board meeting with the figma report kind of Tainted a very concerning picture of our

209district and and it is true it is something that we are working arduously to correct but I also want to highlight the tremendous work that close to 2 000 employees in Alum Rock have done the work that Jocelyn has done the work that Sharon has done the work that Teamsters leadership has done has been amazing we have generated more plans in the in in about three months than any other organization on the planet and if you remember some of those plans we were not able to put into place because things change on us so thank you each and every one of you all the the teachers uh Sandra you touch my heart with what you share because believe me you're not the only one going to bed crying and I know you know that and

210for all of those of you who have spent countless hours Blood Sweat and Tears really committed to bringing the best possible education I want to tell you thank you I'm gonna close my comments with or something that I'm very proud of my team of the 2000 people that make the team last Thursday we had 8 300 students connected to school to classes in Alum Rock now you already somebody already mentioned we have eight thousand and four hundred children that's an amazing achievement very unusual for any District to be able to have proof that we are able to connect with the great majority of our students way over 90 percent so thank you Alum Rock thank you parents and children for connecting because you love your teachers and we love them too but we also love

211the principles the support staff the secretaries the custodians the the field workers each and every one of you you made this happen thank you so much I'm very proud very proud and very humble to serve as your superintendent thank you everybody thank you Dr Bauer uh 5.06 trustees Communications comments any uh comments from the board trusty Quintero trustee Quintero all right um yeah just wanted to uh express my gratitude to all the staff and everybody who's making them Rock uh move forward I got to experience uh back to school night with my uh with my son and uh I got to see the the work that's being done to educate parents on how to make use of the technology and this entire shift over from uh in person to online I don't I don't uh

212purport to to um know what it is at the K-8 school level I've done it in my own day job as uh as I've had to shift over to entirely online learning and it is a struggle even those of us who've been trained uh to teach online to shift all of your instruction online it is a struggle and so for that I want to thank our our brave staff who have uh you know um stepped in and uh and are moving forward to provide that education to all of our students I'm very much excited to see uh everything that's been uh done by our staff and it's being provided in particular the hotline that's available uh to us that every single um uh back to school night at least uh and the ones that we've

213participated in uh were being flashed and saying hey here's your resource if you're stuck if you need support and so very grateful for all of the tools that are being provided to uh parents uh to be able to um support our our children as their their um engaging in getting their education so um you know I know that Alan Rock's best days are ahead of us um a lot of folks like take pop shots at us and we are moving in a positive direction very very excited for what the future holds very excited as well for the participation for the engagement um I know that some folks uh you know mistook some of my comments so those were intended to to illustrate and to explain certain things um but I do very genuinely and I've

214said it before I very much appreciate the the in the The increased engagement that we have uh in the district especially through this tool that makes it a lot easier for people to engage so thank you all for engaging and looking forward to seeing you in those committees and and that participation so we all could collectively uh help uh and and ultimately come to a decision that we all can go ahead and own uh when we have to make those tough decisions so thank you all for engaging and participating okay thank you any other comments from the board trustee Herrera thank you um I want to start off by thanking all the staff and teachers um and along with them you know all the parents and students most importantly for doing your best our best

215as a mother during this time um I know we're all giving it all that we have plus you know um and especially you know despite all the hardships the fires the pandemic um evacuations um everyone is showing up you know showing up to do what um what we're here to do to provide our students with the best quality education um and I appreciate you know all the ways that our communities coming together as well you know whether it's helping you know pass out food or you know uh whatever ways we we cannot contribute and just you know we get to continue to move forward and push and hopefully you know come back to uh school one of these days um it's exciting that we've moved as we mentioned earlier into the red tier um you

216know and and exciting to maybe eventually put into place the plan that we Once Upon a Time um had approved to slowly move back into the schools so that's just exciting it's kind of like that light at the end of the tunnel you know that we'll come back to our schools um and you know just with my uh public information hat that I worked during the day just wanted to remind us to continue wearing our masks maintain social distancing um wash our hands go get tested you know all the opportunities that we have in our community to test to ensure that you know we're safe that our families are safe that our communities are safe and that we push our County to level you know the the yellow level right so the next one would

217be orange um we'll find out on you know next week at the end of next week if as a school district we can start having the conversations of bringing students back right um whatever that might look like for our district um and that's exciting that's exciting um but you know um we all get to continue to do our part thank you so much um Dr Bauer you know congratulations on your award um you know it's not um it's not something like they're like oh we'll just give it to her you know let's throw a name in the Hat you know that it was awful and you know you earned that so thank you for representing our district the way you do um because when you went to receive that award we're all there with you

218you know as Alum Rock so thank you for that um yeah and so I'll leave it at that thank you okay thank you uh trustee Marquez or trustee Chavez any comments [Music] trustee I can't see what's going on with trustee Chavez is that a hand raise or a no while we wait for trustee Chavez to figure signify to me trustee Marquez you can go ahead and make comments yes I'd like to thank everyone um do we know what numbers how much how many of those people were there um I think that would be covera um I was hoping I could see you know how many people would say how many came on but I was searching through my screen I didn't see anything but it's at the bottom where it says participants right now I

219have 62. that's where you can always see the number of people that are in there my my okay my cursor has to be on and it's way at the bottom it's not turning on so oh yeah I see it now it's at 61. somebody just went out I guess yeah we lost one yeah but I just want to thank all the participants that were here tonight and all those that spoke um I I was gonna say something and I I did tell you I'll wait till you know we make our comments you know and uh I somehow I went to the ladies bathroom and then I came back and I can't find my notes for that paper so I'm going to pass for the sake of time you know so um thank you um all

220I do want to say um stay safe you know and do all the right things you need to do but the way you could really help is staying home to stay home only go out to what you need to go do you know your doctor's appointments your grocery shopping and uh you know that don't have to wash the car just leave it like that until you know all this slows down all the fires and all those things that are happening with us but it's kind of scary when you wake up and you're like in a yellow Globe bubble here and not not a clear I couldn't even see the mountains for so many days and I live very close to the mountains so um I just want everyone to stay safe and stay engaged please

221stay engaged thank you thank you trustee Chavez with your background on I can't really see um no comments I have no background on and I've been muted yeah you have a background on our screens you have your background on the Golden Gate Bridge is Oh I thought you meant like noise background oh no no the that that I can bear that's why I'm just making sure I can see you whether you're okay because the guy was in in my neighbor's yard are going off oh no comment thank you okay thank you um so I'll just make a couple of brief comments one um I do want to Echo comments by made by a couple of my colleagues with regards to uh covid and and you know we're all like they say we're all in this

222together and it's so challenging to all of us on so many different levels but I will say just speaking from a personal level in my own you know neighborhood neighborhood and and as I see things going around I I see a lot of you know our community having you know big pachangas big parties and and you know I seen it like look like a quinceanera and like many many people no masks um and so you know that's obviously everyone is going to make their own decision how they what they feel is right for their families but um I would I would just encourage our community to really think about how seriously we you're taking some of the recommendations because I mean it shows in the numbers the hot we have the highest numbers of of

223covid here in our area and and some of the behaviors that I see um I mean I'd like to be out you know visiting friends and doing those kinds of things but unfortunately you know in my opinion that's not a smart thing to do right now so I'll encourage our community to to think about that in the name of our of your family your community and on all of us the second thing is um I just want to mention that so myself and I believe trustee Quintero as well have been have voiced on numerous occasions are um support and eagerness to provide open space here in the community for families to be able to go out and recreate and spend time with families and you know if and when it's safe to to gather and

224and you know to different levels out in public we want to support that and there is a North Capitol Avenue there's a new development that is occurring out there on Jim Ellie I believe is the street Jamelia and North Capitol and so one of the things that I I learned when I was on the Parks and Recreation Commission is that when these new developments happen there's a requirement for them to provide a certain amount of of public space to be available to the community and so that there is a park that is being developed there and there's an opportunity to name the park um there it currently doesn't have a name so our community has the opportunity to there's there's criteria that on my Facebook page I put the the Flyers that you can see

225the what you need to name it it could be after a significant person or a historical event or things like that so I would encourage you if you have thoughts or ideas and want to have that part named after a significant person or event in our community that you take a look at that um and so with that uh uh that's all I have for tonight so um we can move forward to item 6.01 approved word policy actually at this time can I actually um ask trustee vice president to take over I need to take a bio break so on 6.01 can you can you run the show for now yes and actually I'll be running the show because the next item is actually 6 I'm sorry six point six points so go use the

226restroom take your time oh you know what I'll stay yourself from now oh you'll stay for this one yeah because I do want to I do want to be here for this one I forgot that we had made that modification thank you for reminding me but then after this then I may I'll make my request so we do we did have the request to move item 6.09 before 6.01 um so that is the approved board resolution number 14 2021 censure of board member Dolores Marquez I believe you you have the floor on this it's it's a resolution that you brought yes thank you um and I'll start off I'll just uh read through the um Center and then um go from there the Alum Rockingham Elementary School District board resolution number 14-20-21 Center of board

227member Dolores Marquez for stating statement of hate and inciting others to violence whereas the Alum Rock Union Elementary School District board by law 9 000 provides the Board of Trustees has been elected by the community to provide leadership and citizen oversight of the district the board shall ensure that the district is responsive to the values beliefs and priorities of the community and for their states establishing and adhering to standards of responsible governance and whereas the Alum rocking Elementary School District board by law 9005 states to maximize the board Effectiveness and public confidence in District governance board members are expected to govern responsibly and hold themselves to the highest standards of ethical conduct and whereas the Alum rocking Elementary School District board by law 9006 Board of Trustees code of conduct provides that the board and

228its members will conduct themselves lawfully with integrity and high ethical standards in order to model the behaviors expected of staff and students to build public confidence and credibility where that whereas board by law 9006 section 3g-3i further provides that to build trust among members and to ensure an environment conducive to effective governance board members will G demonstrate respect for the public as a whole and community members individually at all times and in all situations H demonstrate courtesy and respect in your Communications by being responsive to one another and to their superintendent and all staff I re refrain from personal comments and attacks against each other staff and members of the community whereas at the August 13 2020 regular board meeting member Dolores Marquez voiced her disagreement with a board discussion stating that as to the

229superintendent the board president and board vice president at The District's legal counsel I hope they hang you guys for this and whereas hangings in this nation are a symbol of hatred and oppression against ethnic minorities including especially black indigenous and people of color and whereas the board respects the First Amendment rights of freedom of speech of all citizens but finds that Dolores Mark is statement was hateful and incitement to violence and disruptive to the orderly conduct of board's meeting and was made by her while sitting at and participating in her official capacity as a board member and whereas on October 10 2019 this board adopted a resolution number 8-1920 censuring Dolores Marquez for receiving and depositing a five thousand dollar casher's check on October 4th 2016 in violation of the law and board policy and

230failing to produce any documentation and substantiate the source of the money and failing to report contributions totaling 1750 and failing to report expenditures totaling 2330 on campaign disclosure statements in violation of the law for which she was fined seven thousand five hundred dollars by the fair political practices Commission and whereas in resolution 8-1920 the board also requested that Dolores Marquez publicly disclosed and substantiate the source of the five thousand dollar cashier's check referenced above to assure the board and public there is no conflict of interest on any matters before the Board of Trustees whereas Dolores Marquez has refused to respond and failed to disclose and substantiate to the state and to this board the source of the five thousand dollar testers checked she received and deposited in support of her 2016 re-election campaign and whereas

231the board finds that by her statements and conduct and her failure and refusal to respond to the previous censure resolution 8-1920 Dolores Marquez has demonstrated that she is unwilling to abide by the policies and principles of a good and responsible governance by which this board has adopted and is responsible for observing and enforcing now the there it be resolved that the Alum Rock Union Elementary School District Board of Trustees does hereby Center board member Dolores Marquez for the conduct as described above be it further resolved that the board denounces Dolores marquez's views of hate speech and incitement to violence and finds her conduct to be a syrian's offense and violation of board bylaws be it further resolved and directed The District shall not disperse reimburse or spend any funds for any trainings workshops conferences or

232events training materials or related travel or any other expenditures for the benefit of Dolores Marquez until such time that Dolores Marquez has attended and completed trainings in one anger management two board governance and three implicit bias to be selected and paid for by the district and she provided reasonable proof of the completion of such trainings to the satisfaction of the board be it further resolved that the Alum Rocky Elementary School District board directs that a copy of this resolution be placed immediately on the district's website for a period of 60 calendar days as appointed and especially elected officials we must set the example for our students it is quite upsetting to hear you the Lord is lie over and over as I previously mentioned you were censored censored last year and you were giving a

233map on how to repair things how to make wrongs right and learning from that experience but instead you lied through a tantrum and told us you would bring an attorney to address us and to this date you have not done either you stay here take up space and time twisting words and lying to your viewers in TV Land the good thing is that I know the members in our community are intelligent can read through the lies and understand how serious it is when a civil grand jury recommends that you the Lord is resigned because of some of your actions as a board member and of course when the truth is brought up you want to cover it and state let's just move forward we must be able to have difficult honest conversations when although we

234may disagree at times we can always promote promote and invite intelligent thoughtful honest discussions focused on our children of Alum Rockingham Elementary School District and Dolores just because you disagree with what is being said or how something is being said it has never never okay to speak with hate or incite others to violence the behavior you continue to display is not only disappointing embarrassing but unacceptable at this time with the harano's permission I would like to give you time to respond as I'm sure you have plenty to say about this matter thank you so before we go there um I want to make sure that we provide Pub time for public comment um do I move to motion I'm sorry before we go there I'm sorry go ahead what was that motion to uh right

235before we move on I'm sorry I uh motioned to um accept the board resolution center board member Dolores Marquez okay um and just clarify Mr Ruiz that the person bringing the item can um put okay so is there a second to that motion thank you is there a second to the motion that's on the floor oh yeah if there's a second to the motion oh I'll second the motion um just because I'm unmuted right now so now that there's a motion in a second um if we could take public comment on this um and then we can do questions and comments after that um so Mr Gill do we have public comment on this item yes sir there are a few okay can we get the clock up um who is the first person listen

236Golani okay Miss singalani when you're unmuted and You Begin speaking your two minutes will begin thank you I'd like to note that trustee Dolores Marquez is the second member of the Alum Rock 3 to threaten our superintendent and her colleagues with physical violence and the last of that old board majority that's left on this board our students and families deserve ethical leaders who do not speak with the hate we hear too much of in this country who behave with dignity and integrity who treat our community and their colleagues with respect who take responsibility and don't waste our time pointing fingers and blaming others trustee Marquez you have governed on this board for nearly 12 years the idea that you have no responsibility for the problems the district faces now is absurd beyond belief if you

237won't take any responsibility for governing this District then why are you taking up a chair why are you asking this community to put you in that chair leaders who take no responsibility and people who threaten our community with violence have no place in leadership thank you next person Mr Gill it's Claudia when you begin speaking your two minutes will begin hi can you hear me yes okay hi my name is Claudia cuello I'm a parent and a member of Empire now I do appreciate that you guys are doing this and I do agree that there has to be an example stood out for the rest of the board members and just in general this is not acceptable but I also do see um how other members also laughed other members also pushed um this board

238member to limits to where she had to say this and that should not be bypassed either um it should also be made aware and they should be um so as examples as well so because at some point um every board member has pushed at the limit and said things they shouldn't have said and it's just something that is not it's ongoing you know always wasting time always being aggressive and it's come to this to where she had to express herself out of um frustration perhaps because I was in that meeting and there was things that happened before um she stated that that are not being addressed right now and um I do agree what she said was wrong but I I also would like for you guys to address the fact that there was other

239things wrong within that meeting as well thank you next person Elizabeth Sanchez hey Miss Sanchez when you begin speaking your two minutes will begin good evening members of the board and superintendent um my name is Elizabeth Sanchez and I am parent here in the district and I'm also part of as a community member um so I just wanted to Echo what um um the participant Claudia and fellow member of says that we would recognize and applaud you know the members of the board specifically to bring this up to the board members and that are treating it um with all seriousness as it should we would also like to request that you know uh comments that incite violence and demean others are continued to be brought up to the attention of the board and are treated

240as violations of the board by our laws as they should be in addition the behavior and the reactions of other board members which sometimes are tend to be uh passive aggressive against our immigrant community and members of colors and ethnic minorities should also be taking in seriousness these derogatory comments take away and extend the time necessary to complete and approve board policies that are listed on the agenda beforehand and we ask that the board refrains from such comments and focus on the vital critical and decisions that need to be made um that will ultimately impact our children's education so thank you have a good evening thank you next person Mr Gill is Vector Vasquez okay Mr Vazquez when you begin speaking your two minutes will begin uh Buenas um yeah the comments made by trustee

241Marcus took me by surprise they were necessary definitely hateful and like the racial Equity awareness that's necessary as a policy leader having such racial Equity awareness is critical as we move forward in our policy development I hope this boy doesn't does vote to send you the trustee and I agree with the comments made by the public that we must take races bias xenophobic Sexes and despotism just a series in the future we know that lynching is is a process used by mobs to terrorize black Mexican and Asian communities usually people who assert the rights the voting power the human rights and who sought employment and Justice in society they should not be taken lightly we know that the American South used this strategy on free black people to control them we know that then so

242NAACP has recorded these incidents and over 70 percent of all lynchings have been impacted black Americans but we also know here that in the southwest mexican-americans were the victims of lynching at the hands of wide mobs and even the police call police force cause of Texas Rangers It Is by no coincidence that also the only woman to ever be lynched in California that we know of was the Mexican-American woman named josefa Segovia in the last couple of months Even in our in California New York and Texas there's been at least four lynchings of black people in our communities some say that the police murders that we see today is a new form of lynching that we are seeing I agree with the community and hope that all the trustees can learn from this experience and

243then I use this kind of word in oppression lightly they're not welcome in our spaces of decision making and I hope that we take this as an opportunity to learn and grow as a board thank you so much thank you next person Mr Gill yes Brenda Zendejas missendejas when you begin speaking your two minutes will begin hi good uh good evening board members and superintendent it is important to being civil with one another when being an elected official this vote shows that Alum Rock will no longer tolerate threats or inappropriate comments of any trusting from this leadership all board members should always be respectful to each other and to the community and to their superintendent and I support the censorship of any board member who breaks this I think this is a learning experience for

244everybody on this board and anybody thinking of sitting on this board to know that you will be held to the highest standard when you have a seat that you are being put here by the public and being put here by the public means that you have to respect each other and everyone in your community and I want this board to change into the right direction and I know it's going to happen and I have faith that it's going to be um a more positive outcome of not only these board meetings but as a whole District so I hear support um any censorship of any board member who breaks any of these things when um you make unacceptable uh comments thank you next person Mr Gill is Laura um I'm sorry what was that is okay

245um do we have okay hello is Laura is that the person instructions foreign uh I don't I don't think she can hear you what does it say Avatar before you switch it yeah interpretation okay interpretation in English interpretation yeah Senora Laura oh she's on mute can we unmute her son see okay interpretation um it says Spanish it just says Spanish okay mucho gracias can we test it before we go um say something interpreter please okay they say um yeah I'm sorry um it sounds like we already have um interpretation uh-huh um Corina thank you um next person Mr Joe and you're on me oh there you go well that's Veronica okay Veronica when you begin speaking your two minutes will begin great um I'm bored and again thank you so much for um to trusty

246Karina for bringing this resolution and I hope everyone does approve it um and vote on it um I also want to Echo what my colleague said about um what it took us to be here right and if we go back into those recordings we see that inside of microaggressions that daily that are happening in this war unfortunately it is not the first time and not only has she or any or everyone else experience microaggressions for certain from certain trustees but also the community I have experienced it myself with some of you trustees so I want to make sure that because we are censoring something like this that we also look into sexism focusing and everything else that needs to be censored um it is just as crucial that we censor any kind of violent language

247and any kind of microaggressions that we might not see daily so I urge you all again to continue on with your profession professionalism as you've been all doing today it's been great um really targeting the like us just professionals um I really appreciate that thank you thank you next person Mr Gill gilzer okay tilsa when you begin speaking your two minutes will begin thank you I would like to Echo what the rest of the speaker said Thank You trustee Corine for bringing this to the table and taking matters as serious as they are this kind of statements about color vocabulary is not acceptable especially in this time where we're living on on fear and people in our communities being constantly attacked by racism microaggressions and everything out there but I also want to Echo that

248it is true that our trust is from this board has been microaggressive and they have used their power to not only uh being aggressive to each other but also to that community and to let people here I can recognize that I was a victim of violence and my corrections as well as people outside and we want to make a call out it called out that to take actions every time and on time and stop it when we see it or when we heard it uh stress these you guys need to hold each other accountable not going into these kind of situations get up situations get out of hand so um thank you trusty Karina once again for stepping forward for being that leader that our our Board needs now more than ever and for taking

249matters as serious as they are and for the rest of the trustees please learn from this situation please keep this kind of of um ongoing board to meetings I'm going this is how it should look like concentrate on our kids education concentrates on being humble to each other uh would you like don't have to be best friends but you guys do have to respect each other and if we talk about families and we talk about kids then let's show with that let's start with that so thank you everybody and have a really good evening thank you next person Mr Gill I'm good okay thank you everyone um so at this time we can there is a motion in a second we've had public comments so we can open it up to comments from comments or

250questions from the board um are there any comments or questions from the board trustee Chavez uh I want to thank the district for giving her the opportunity to take the classes the anger management class and I want to invite um if it's at all possible the whole board to go um I think it'll be beneficial to all that's it thank you thank you okay any other questions or comments from the board uh trustee Quintero go ahead um yeah um you know the ability to engage in our Democratic process requires us to be able to speak freely to engage to share ideas uh even if we don't agree with them um and so that's uh what allows us to get our job done um threats of violence uh go ahead and pour cold water on on

251Democracy they go ahead and they shut it down even the most conservative the Supreme Court Justice Antonin Scalia was of the mind that uh individuals had to that it was more it was more healthier when people had different opinions and they were they were forced to go ahead and interact with each other um that was in reference to a to a case involving um a lawsuit about student groups people not wanting their fees to support groups they didn't agree with so the point that I'm trying to make is that this there's this free flow of ideas is important uh we are all uh elected or appointed here in one way or another to go ahead and bring those ideas and we bring the voice of those folks that brought us forward and um it's important

252that we be able to do that uh without any without any types of threats and stuff of that sort uh so um thank you for bringing this forward um I have a quick question for Council uh with regard to the language because I don't want to move forward on something if it's not going to be uh going to be able to stand up to some legal challenge um does the requirement that our colleague attend uh those classes is that going to be is that enforceable is that legally enforceable by this board through the action tonight or is that something that can be challenged and it's going to take us into a big ole Miss and a lot of problems in the future and so that's a question for Council board president I don't know Mr

253Ruiz do you have a response for that so so the the board cannot compel that attendance as a condition to any board member exercising their rights as an elected official which would include voting rights and and stipend rights and benefit rights things like that all right um so but uh in in the language on the item it says uh uh access to trainings and stuff of that sort of travel professional development this is is that included because you mentioned stipend rights but uh would that apply to the other stuff oh I'm sorry uh okay I don't understand your question no wouldn't apply those because those are those are privileges that that the board provides to um one another gotcha okay all right thank you for that information okay thank you um I'll I'll make a

254couple of comments um as as a person who was uh individually called out in the um with regards to this incident I I have a I think the word that stands out the most for me is is disappointment and disappointed I feel I I feel like I've I've done nothing but you know treat treat you trustee Marquez with with the utmost respect to the extent that I can in spite of comments that are thrown my way or things like I I always try to be respectful of you and I appreciate you acknowledging that on numerous occasions um so and I try to do that with with everyone Community other board members sometimes do I slip up possibly I mean I'm I'm not perfect and I may have you know said inappropriate things and I am

255accountable to those things my words are my you know palabrasm is important and so so um but you know I just did not feel that I deserved that kind of what I would classify as vitriol for only trying to demonstrate respect um almost invariably to you so that's one feeling that I had um the second thing that I as I thought about it is is just like the accountability of it when I I thought about it and I talked to you know just some people in general like if we if we had a kindergarten student or a student in our schools tell another student in a zoom session let's say they're having their synchronous time and they tell them I hope they hang you they're going to hang you what would we do would we

256just let that slide or is that an opportunity for that person to grow and develop and realize the the error of their their ways and for a child you know to learn that that's not the way we want to function in society and particularly in our district so so I think you know if we have those expectations for a student why would we not have it for ourselves similarly I think you know I know that our staff and from Administration on down like there I know there's not everybody in any organization gets along 100 and there are disagreements and and people think about things in a different way but if we had a teacher tell another teacher I hope Dr Bauer hangs you or I hope they hang you like how would we what would

257we how would we respond to that teacher for for making a statement like that so that's another question I pose and then finally for me I think you know part of our role as stated in you know numerous documentation and just in terms of governance is really to set the tone of the district to to kind of provide the the the model or the or the the you know how we want to be as a familiar or as a community or as a district however you want to call it and I think that you know there are certain respecting people's I I always try to allow everyone it's a fine line that you have to walk as trustee Chavez and some of you know as president between allowing people to speak and have their first

258amendment and saying what they feel because I agree with trustee Quintero we need to be able to dialogue and disagree there's a fine line between allowing that and putting kind of putting a stop to it when it gets too far and and for me this was very clearly an incident that that went too far and so for all those reasons that this you know I support I think we need to take these types of things very seriously and and oh and the last thing I'm sorry but the last thing is that I do take it very seriously if someone is inciting a group of people to hang me um you know whether whatever they meant by that those are the words that came out and we've seen I I don't you know we've seen crazy

259things happen in society all the time and I don't mean to insinuate that anyone in this meeting who has in my in my estimation a vested interest in moving us forward that anyone that attends these meetings is is like is would do that but there are people in society who who are influenced by by comments certainly and and I take that very seriously for myself and my family and so for all those reasons um I I will be supporting the language in this resolution um is there any other comments from the board or questions and trusty Marquez I certainly would like to provide you with the opportunity to respond if you so choose and if we can unmute her just in there you go so trustee Marquez if you would like to respond you're unmuted

260before we call for the vote on this item yes to Allison Claudia Elizabeth and any other parents that were there at that meeting I profoundly apologize and I'm not just saying it just to say it and get over it no I do one of the comments was said by one of the parents that perfect I I think maybe she's just at the frustration point you know like how many of us get to a frustration point whether at a frustration point or not a frustration point and I was I was so out of order in doing what I did and saying what I said and I apologize for that to you parents that take the time to be at these meetings and to make it a point to put it in your calendar to be at

261this meetings yes I have worked with so many different boards but this one on my last try here it's a tough one but I move forward with all of this because I know that the people that have spoken here tonight are not my they're not my constituents and I was I don't know what I was going to do in my constituents had come up to the podium and hold me and I would have probably gone to their place or talked to them on the phone and just say oh my God you know forgive me I I really am sorry and I don't know how much how else and how much more I can say that that um that yeah I was totally frustrated frustrated that I was trying to get those parents back their time

262to speak that you the gerano as a president were taking minutes away and you Karina you were negotiating with the president well let's just give a minute and a half you know and it was going back and forth and all I could think of this is why they go they come is to speak and to be taking that minute away I I just had to interject and I had to say something in favor of the parents that I wanted to hear what they say and just give them their time I profoundly apologize profoundly apologize thank you any other questions or comments from the board okay I I actually would just like to clarify my understanding is that every person in this district is a constituent of ours as a trustee here I know that I

263represent every single person within the boundaries of Ellen Rock School District um to represent the to the best of my ability their their best interest and so not all of those people may not support me and I certainly understand that you know if that's what was meant by trustee Marquez that these are not her supporters that's understandable but I think we need to remind ourselves that our constituents that we are accountable and responsible to as every single person in the district um and the other thing I just I won't go into details but I think that the characterization of what the hanging comment was in response to is inaccurate and anybody could go back in and see what particular item that was in response to so um I will leave it at that are there

264any other questions or comments from the board and if not we can go ahead and take a vote okay so we will call for the vote on this trustee Chavez oh can we I mean trustee Chavez go ahead uh yeah I think I had to say something um maybe because of the way um I guess in dealing in business a lot of people they have certain ways that they're they speak and some people I remember one incident where my husband told me that I had gotten upset because somebody was cursing at me and they every other word was that word and then and I told them can you deal with this customer because it they're offensive to me and he says why they're not you know that's the way that they interact with people the

265the f word is nothing to them or the way they were brought up that that's what they're used to and I don't even he said I don't think that they know that you're offending them so you shouldn't get offended because they're only words and it doesn't seem like this person is gonna follow through on any threat that he was saying um if he didn't get the price that he wanted for his repair but at the same time it took me a while to to play it back in my mind and think you know I need to forgive him because I don't know what his situation is but I also know that if you don't forgive somebody and and you hold on to it you damage yourself more and the incident of her saying uh hang

266you it's to me at the time when I heard it it was like I didn't think that that's what she meant um because I I guess because I've shared with Dr Bao before when my mother first came to this country um the reason she came was because her husband and my brothers all my brother's father had gotten hanged and she was able to move past it and she didn't hate them and she taught us look sometimes people will do things and say things but later on they're remorseful and I think that I'm glad she told me about it because I didn't grow up hating people for things that they said or did and later on at the time it felt hard to hear but I knew that those people need help and that's why I

267asked can the whole board go because you know everybody has a different life and I'm sorry for getting a cracky voice but um I just think that we need to forgive and move on and maybe we can get past this be more respectful to each other but to me I don't think that that's what she intended to you um that's just my thought and I hope that you can all forgive whatever what was said because I don't hold anything and I just truly think that taking the classes is gonna help and it wouldn't be a bad idea if we all took them because maybe we all need to understand where it comes from there's a route to everything and that's all thank you okay any other questions or comments from the board Miss trustee Quintero

268I really appreciate this opportunity for all of us to engage in I know it sounds kind of weird everyone that we're engaging in some sort of like a therapy session in front of a bunch of people unfortunately on the brown act uh doesn't allow us to go into a closed room and engage in this type of uh dialogue or else we get in trouble um because it'd be a violation of the brown act and so I do appreciate the comments that have been made my colleague Marquez I do believe that uh even though we engage in some back and forth I I do believe that my colleague Marcus does have um uh she she's had the interest of our students when she's made decisions in the past obviously other things we've disagreed on and we've

269been very very public about it um and so I do appreciate the fact that um she was able to step up and and apologize to the folks that were were present um and so that was great uh to my colleague Linda I do appreciate that opportunity for us to go ahead and as a board uh possibly look into uh how to work with each other I I I'm obviously been very very clear on my my opposition to some of that uh some of the things that you stand for such as the issues on immigrants immigrants rights uh women's rights stuff of that sort um but I I definitely believe that you have the opportunity to speak uh and not be threatened or in any way she performed me to feel like you can't uh say

270that and I would I would defend that your ability to engage in that in that in those things that I don't that I don't agree with um and so I appreciate this opportunity for all of us to engage in this I think it's a very healthy dialogue and hopefully we can uh go ahead and take some steps to to move forward and heal and work as a work better as a board thank you any other questions or comments from the board I do agree that I know this is taking time but I think that this is time well spent um in terms of our ability to to continue to to work while at the same time holding each other accountable so if there's any other comments please uh colleagues feel free to voice them I

271I I'm open to entertaining any other discussion before we take a vote and if not that's fine too okay well see none um I will go ahead and call for the vote as always as I see you here on my screen um so the first I see trustee Chavez uh the mo or the motion is to um to approve of the resolution as presented motion and second so uh we're calling for that motion trustee Chavez oh sorry can we mute everybody um Mr Gill so we can hear their their votes I'll be abstaining abstain okay trustee Marquez I'm not sure if you're here still but she's muted can we unmute her in case she's there or I don't know she's muted herself and there we go trustee Marquez no okay trusty Quintero hi and myself

280here that's possible okay um I think you said you would like to if it's possible I okay yeah yeah I would like to keep it as short as possible okay why don't we go ahead and hear your presentation then and then we'll um we'll go ahead and move forward after that so do you need the screen and if so does he have it Mr Gill there we go yes so thank you um again the an auto actual report is actually you know as a reminder it's a look back in terms of how the districts uh did in terms of how much revenue we receive and also how much expenditures uh we incurred um in the previous year which is uh 2019-20 um with that I'll start with the total revenue in the general fund um

281in total the districts receive 134.7 million dollars of that total um 114.5 is unrestricted dollars and 20.2 is restricted um this slide shows the total uh general fund expenditure uh which the in total the district spent uh 137.3 um of that um 92.3 of it is unrestricted and 45.45 million is restricted dollars um this graph shows you a summary of both the unrestricted and restricted side um starting with the unrestricted general fund uh the districts started the year with approximately 11.2 million dollars in beginning fund balance uh it received 114.5 in Revenue uh total expenditure of 92.3 um a total transfer out to the restricted side of 20.9 and the districts actually incurred a surplus um in the unrestricted general fund to bring the ending fund balance uh to 12 from 11.2 to 12.4 million

282dollars um on the restricted side um the district started the year uh with about 4.4 close to 4.5 million dollars um and a total revenue of 20.2 million dollars uh the district spent um on the restricted side 45 a little over 45 million dollars and we see a contribution from the general fund of a proxy 22.5 million dollars um spending down the carryovers um of 2.2 and ending the year um with 2.2 on the under certain side so if you look at the net uh balance or the ending fund balance uh for both the unrestricted and restricted um the districts is end of the year with approximately 14.7 million dollars in any fund balance uh this chart chart shows you the um the details of all the restricted um balances and the general fund uh

283we'll start up at Lottery um Lottery uh we have a little over nine hundred thousand dollars in carryovers for next year and this is deliberate because we're um saving this money in order to implement um textbooks um that will will lead to adopt uh in the coming years um we have uh some carryovers in the classified school employees about 63 000 we received some one-time money um in SB 117 uh related to covet and so we uh we have a reserve our carryover of 86.6 um thousand uh for that button um the low performing student block grant uh we have a carryover of 171 000 uh routine maintenance this is a contribution that we make from um the general fund to our routine maintenance um and there's close to five hundred thousand dollars in unspent

284money there that will be used up next year um and then for other local restricted these are mainly um donations um from local governments uh to school sites and the districts um and these for some of these monies are mainly condolences for certain purposes um we have a little over 931 thousand dollars and then lastly um you'll see here that uh the Coronas Relief Fund we actually have a negative here and it's really not a negative it's the way um the state has allowed us to account for this money so we talked about the corona uh Relief Fund we're really getting most of our funds actually all of her fund in year 2021 but the state is currently allowing us to go back uh to the middle of March when um the pandemic hit and

285apply any expenditures um that we are able to uh use the the corona Relief Fund for and so while you see that there's a negative 450 um that negative 400 fee will be eliminated once we receive the money in the current year and so as a total um there's a carryover on the unrestricted general fund balance of a little over 2.2 million dollars and with that that concludes the presentation of the unordered actuals okay thank you Mr Chang so now trustee Chavez if you would like to put a motion on the floor you yeah no I don't want to no more okay motion okay there's a motion to accept or approve the report and a second is is there um public comment on this item Mr Mr Gill is not there um so is any

286questions or comments from the board I do okay trustee Marquez um Mr Chang um Calera the the book I have an 8.1 okay is it did not show me what you had up on the on the screen right now so can you put up the screen um the first one and I have questions on the first one and then the second page foreign that one and then and then we'll go to the next one so um on let me see if it's kind of small for me to read okay um when you thank you when you combine the general funds like that um restricted and non-restricted okay um you have you have something that says straight their capital outlay and outgoing and other correct yes okay so is that a capital Outlet a charge to

287programs that you we are working with or do dealing with or how did we get the money so the capital outlay uh refers to uh both um Capital uh projects or um or or programs that we send money out so for example in the unrestricted Journal fund uh the bulk of it is for our surf program where we're paying for our yearly premium to participate in that program and this is second year but this is the first year that uh we incurred on there um on the restricted side um those are some of the charges that we send to the county for them to run um both of it our Alternative Program also special ed so those those are the bulk of it and and those money come from the county office no those money

288those money comes from the state um bulky in the unrestricted side um in the form of lcff and so some of those monies are you know we referred to a cost on the um on the restricted side where the county office is serving um District students and so um on the restricted side the districts typically and most sisters don't receive enough funding process for special ed um for to serve our own programs and also to support uh the programs that are run by the county office so that's where you see the excess cost where um the you know the district receives special money ask for money for special ed but it never receive enough so on top of that um the the County census appeal for all the students that they serve on our behalf

289Okay so hello yeah go ahead okay so then when I looked at that at the final total of three million um that 3 million is then um is it just general fun not restricted around restricted just general fun so we could use as we need uh which which line are you referring to uh trusty Marcus loudly you know when you get to the total at the other end the 37.59 the three seven yeah the three million 759. so are you telling us so those are monies that we can use and whatever we want I use it's not restricted or not are unrestricted and restricted it's just money for us to use the the 3.7 is a combination of the um which is the 922 um plus 2.8 um the 922 pertains mostly of our serve

290programs that we pay out on another 2.8 is related to our specialized services that we're paying the county I understand and now when you combine them does it then become unrestricted or becomes restricted no when you combine them they just combine both the uh the you don't differentiate the the two it's just as a total general fund expenditure in that line item it amounts to 3.7 million dollars but off that 3.7 um 922 um are unrestricted expenditures and then 2.8 is restricted expenditures I got it all right I got that now can we go to the next page please this one yes thank you that one on a routine maintenance account now these are monies are the end and balance of all of these um these uh Lottery classified employees the block grant that's still

291there right yes yes and those are all restricted dollars [Music] discharge right here is uh I I saw it from the top so if this is restricted with and because of the parenthesis I don't think I don't think that most of us got um got to hear your explanation so the coronavirus really Relief Fund the CRF it's in parenthesis a 250 a 450 000 200. so the the so it became restricted but you also said the state will let us use it that's how they just give it to us and we get and we can use it yeah the the corona uh the coronavirus Relief Fund all of it uh are restricted dollars and if you look at the um 2021 uh 45-day Vision a revision uh budget report you'll see that all of that

292revenue is being recorded um on the restricted side of the general fund and that's by and that's by state rules um and so the the timing of the um of the funds was a little tricky um the state is providing that Fund in the current year in 2021. um however uh the state recognizes that okay there could be expenditures um in the last fiscal year that you can use this money and apply this to um for example if you need to um allow CNS program to um incur additional expense to run some of their programs so we can use that money for that and there's a list of allowable expenditures right that we can apply to coronal virus really fun to and so it's a timing difference in terms of how this is being reported

293um and so last year we were able to identify a little over 450 000 that we can use the coronavirus and refund for um that 450 will then zero out in the current year uh once we when we apply that to the revenue that we received are you talking about the money that has not and the state hasn't sent us yet correct and what what is the amount what is that amount that the state has not sent us uh I believe where it's about 9.5 million dollars that we're receiving in Corona virus release fund and it's a one-time fund s okay but that that's the coronavirus money right correct yeah okay so then on top of that we get our Ada right uh yes most are are Ada money that we get in lcff will

294not be reflected on this chart it will be reflected in the unrestricted general fund okay so because um from the last time uh we had we we have we have gone down um to 84 um 88 400 students approximately you don't have to give me the whole thing revenue is that for the Ada uh what portion of the revenue because it's different type of Revenue or the Ada okay you know the money they send us for every student that sits here on the chair you know in our district you know they send it and we were we were at at 10 000 students and now we're down to eight so what is the loss difference and I think you're referring to lcff Dollars um because that's mainly the bulk of the revenue that we received

295okay um yeah and so roughly we received um I remember there's there there's new changes allowed this year um in terms of the whole honest um this year you may recall that at the 45-day division um I informed the board um that there's a whole kindness provision where uh the district is I mean the state is not collecting Ada um for the current year and therefore they're applying the whole part in this which applies to last year's Ada uh with respect to calculating lcff dollars and so um it will be based on last year's Ada um and in terms of lcff dollars uh roughly about 99 uh million dollars index okay okay thank you okay thank you um so we we're at 10 20 right now do we want to go ahead and take a

296vote on this and then and then see if we take action on our time do we is there any other questions or comments on this item there is a motion and a second on the floor already okay so let's go ahead let's go ahead and take the vote on this one as I see you on my screen um trustee Chavez did she disappear no I'm here oh trustee Chavez I didn't hear your vote on this um I guess so um just that anytime it's in the negative you know I I just don't feel right about it proving it but I do want to support the staff and all the work so I guess it's a yes trustee Marquez I'm going to abstain I still have way too many questions but given the hour that you

297just said we need to extend I'm just gonna abstain on this um okay uh trustee Quintero I and myself I so motion passes for in favor one extension trustee Marquez um so at this point it's 10 21 is there any um recommendations can we move uh to 12 o'clock the meeting meetings there's a motion to oh go ahead or were you done who me yeah yeah I was done okay so there's a motion to extend until 12 o'clock midnight is there a second to that yeah I heard with the second is there any discussion or questions about the motion on the floor okay so let's go ahead and take a vote on it trustee Chavez hi trustee Quintero all right and myself I motion passes unanimously thank you everyone so um let's move to item

2988.02 update on California school Finance authorities pool trans program I'm gonna go to the office real quick okay okay thank you uh is there a presentation on this one Dr Bauer no okay then is going to give you sort of like information only covera just I also this is kind of let them know what it is so that the public also knows yes yes so the information is on the on the board cover but I'll Briefly summarize it um in response to uh the state deferring um apportionment to school districts they are offering a um a core trans um for okay to 12 districts throughout the state of California um and this is the Tibet to get leverage in terms of when we go and issue the trans um to deal with the state deferrals

299um and this is just some information in terms of when the pros are happening um and the earliest that the pro will be implemented this year uh it actually starts in February and there's going to be um for over five month period starting February including March April and May and June so that's why it's necessary for the districts to um to already start looking at different options to uh deal with this the the delay that the state is is imposing um on the district itself and so so we have submitted an application to participate in this poll trans program there's no cost at this time the board will need to take a vote and approve a resolution at a later date um hopefully by October um but that's kind of a moving Target right now

300in my conversation with some folks at the at the state level but we'll bring back a resolution for the board to consider at a different day but this is mainly just for information in terms of providing an update um on on the the cash situation with the with the district and this and the and the this the state and the solution that are being out there I'll be happy to take any questions just so that everybody knows more or less because you're talking about five months starting in February for the state not to send us their monthly payment to us can you just tell uh I know that uh trustee Marquez had that question during her one-on-one about how much per month yes the moving Target but that way everybody knows about every month this

301is how much we get yeah so typically um the state sends us apportionment on a monthly basis um but you know with this the state being short with cash um The Proposal itself typically on a regular month we will get between eight to nine million dollars um in lcf dollars um the state is not um deferring 100 for each month um except for June so um 100 of the June apportionment will be delayed um but in terms of February through May um the typical month let's say we receive uh eight million dollars in enforcement we would we would only be getting about half of that from February through May so um it is it can get a little significant over a four months or five month period um so we talk we're looking at about

302maybe 15 to 20 million dollars um in apportionment delayed by the state um by the time they it gets it gets to us um in the next fiscal year that monthly number I didn't hear it It beeped out on here for me so typically this yeah are typically the districts will receive about eight million dollars um in apportionment on a monthly basis okay um but the the full schedule that the state is proposing right now they're not they're not uh deferring 100 for each month they're deferring about half um of the questions that the district is supposed to receive so if you do the math and you know for four months uh at four million dollars loss or delayed in apportionments about 12 and then in June itself it's the whole month um so it's

303about you know 8 to 12 to um about 12 to 20 million dollars all right thank you thank you Mr Gill is there any public comment on this item okay thank you so we'll move forward to item 8.0303 um update on request for proposal for program management services so my understanding is that this is information only and my understanding is that we need um staff needs some direction on how to move forward with this did you want to present something first Dr Bauer if you have it on the board cover um the potential scenarios for the board to choose or whatever else the board chooses to do in the past it's in the the most recent process the board this board went through the selection of the law firm so that's what it's kind of

304it will be mimicking that um for the board to consider the applic you know the applications and interview the finalists the one everybody who fulfills all the requirements that's one way or the war chooses to tell the staff you guys can select a committee and you you know you the comedic brings the recommendation to the board or any other way that you choose to do we just need direction from the board to select this um services and just a little bit so the public knows I think it is in the board book but just for clarity it's a six a total of six potential um I think I heard you yeah I would suggest that we follow the model that we had for the law firm and it worked out well it wasn't overwhelming and

305uh you know it was a very very open and uh process so rather than stay here and try to figure out a whole other process I would suggest we follow that same model can I ask a question uh so for the ones that we have have they been determined already to meet all the criteria or they have not gone through that yet yeah I'm sorry yes we have that at all the um all the proposals and all six proposal meets all the requirements that were set forth in the RFP Okay so um I mean I do like trustee Quintero suggestion I think that process does work my my proposal or at least question to throw out there is I'm wondering if maybe staff can um go through a selection process to bring us the top

306three candidates so so um because I don't remember do does anybody remember how many candidates we had for the law firm and I'm just trying to think of how exhausted that process would be so we had three so excuse me sorry I think we had more than three yeah it was a it was more than three it was closer to six but I think in all fairness we should probably take all six okay so if we had so if we did have I think I do remember it was more than yeah it was more than three yeah um and that was doable within one evening so if that was is the case then that would make sense to to take all of the interest I think if I remember correctly and uh class remember is

307I think they did the entire sorry I'm hearing that go um candidates and then they rated them they gave us like a sheet with how they rated them and then based on that we invited the top whatever x amount um of candidates well I think I remember something like that I I think what they did was they they pulled out the ones that didn't meet like for instance they didn't answer a particular question those that met all of those requirements those came to us yeah I believe similar yeah approach so in this case it sounds like all six have met those require requirements so I've heard several people now say that we should just take all six and use the same process we used that we'll have to brush up on and dust off the

308dust and make sure we have it down but the process that we use for the selection of the law firm is that sound like we're um on the same page with that so same process as the law firm selection and bring all six candidates okay um so do we have should we take I think maybe we should take a vote even though it's information only just to make sure that all or Mr Ruiz would you suggest that we take a vote or do we have consensus enough to go forward we have Direction okay I know sometimes I I would you know we do take a vote just to formalize it a little bit but it sounds like we're good to go so staff you have the direction okay so that's it for that one thank

309you everyone um we'll move forward to item eight point zero four approved citizens Bond oversight committee appointment well to approve the motion to approve there's a second um is there a public comment on this item Mr Gill is there is one okay might have better can we get the Brenda's in the house Mr President yes we did not ask the public for their comments on this last that's when we were just finished doing okay um thank you for that reminder so so for the public um at this time it's open to public comment on um this item or the previous item is that is that a permissible to do Mr Ruiz yes okay okay so that being said um Miss Zendejas can you when you're two minutes starts when you start talking but can you

310let us know which item you are speaking to this is item 8.4 or um I was just gonna say that I think that um it would be nice to have an oversight committee um with community members too um also good for you guys more insight on um the process I think that um it would be more transparent process with no conflict of interest of anything if you have a community um to give you guys input thank you so was this speaking to the selection of the project manager um I don't know the one we were just okay on the other one okay so thank you okay um any other questions or com I mean any other uh public comment for this item or the previous item and okay thank you I just I do have

311a question I don't know who I would address it to if it could be answered but just on the application um under the qualification section number one I just I think it says also I was a CEO of a company so is that is that what that says I don't know if anyone can clarify that or even missing Golani um it's kind of make it out either I believe it says I was a CEO of a company but I just wanted to if we can't get the confirmation I'm going to go ahead and assume that's what that says but I just wanted to get clarification but maybe we can't so that's okay okay um so any other questions or comments on this item okay so we let me just clarify for everybody if for whatever

312reason this gentleman does not fit the business the board can always change we have with all of the applications that have come before the war we bring them in good faith you know we all the the applicants have been thankfully supported by the board this is a committee that is very difficult to find members for and if there is any concerns in the future you have a very strong committee right now that will be betting you know the participation and if for whatever reason this does not match then they can always bring that to the board I just wanted to make sure reassure everybody that there are checks and balances and if they don't happen to fit a particular one of the categories they can still be a part of the committee just in a

313different uh example or whatever yeah yeah trustee Chavez did I see your hand actually Dr Bauer just said and answered my next comment so okay thank you I appreciate that okay so thank you everyone it looks like we can go ahead and take the vote on this one so trustee Chavez right back to you for the vote go go to the next one this time for a second just I gotta weigh something first okay uh trustee Marquez hi trustee Quintero hi myself I trustee Chavez I think I'm gonna abstain okay so um motion passes for in favor one abstention from trustee Chavez oh before we leave it can I ask one question yes so the The Works in Morgan Hill is that I'm I'm to understand correct that's where he put place of employment all

314right yes yes okay I couldn't read it it's hard to read okay thank you um item 9.01 information only resignations is there any public comment on item 9.01 there is one floor de Leoni okay Miss de Leon uh when or once we get the clock up when you begin speaking your two minutes will begin yeah so I just I just wanted you didn't never ask for public comment on the previous um uh on the other side committee and uh I just want to say I'm sorry stop the clock please which which item are you speaking to the previous one the 804 the one that you just finished you didn't give the people the um I had my hand raised and you never get the public comment option okay sorry about that that's uh that's two

315that I forgot okay remember when when Brenda spoke that was one that was public comment for this one and for the previous ones oh yeah yeah I actually did I combined it with 804 and 803 but you can go ahead and reset the clock please we'll take the comment for 804. yeah so I just wanted to say that you know as long as uh we don't have anyone from the Altera everyone is welcome and as as long as they have a good fate of really uh not taking advantage like in the past other people took advantage of this committee and yeah thank you Bowers for um Dr Bowers for clarifying that so that gives us an idea that we can always uh look into if there is something suspicious with this person because it feels

316like some community members have brought out that to attention thinking that something was linked to the terra's uh area where they are are or were working and I just want to make sure that we don't have any more of those uh type of people thinking of taking advantage of our committees and yeah we're gonna be paying attention to it thank you okay thank you um so we'll move forward now to item 9.01 resignations information only is there any public comment this item Mr Gill none okay thank you um do any questions or comments from the board on 901 okay so that's information only so we can move forward to the consent calendar um is there emotion on the consent calendar I do have one item that I wanted to ask questions on which is 10.04

317any other items to pool or any motion on the floor for the consent calendar can we unmute Rogelio and get that comment or clarification is just as a formality you might want to close the public hearings that were opened at the beginning of the meeting now right now okay so just simply and I need to close them individually right yes okay so those were items 2.0 I I hereby close um item 2.01 public hearing item and next I is it just simple as me stating it do I need to take any okay it doesn't look like there's any anybody who wants to speak on these matters anymore anyway yeah okay so I I guess I hereby close public hearing item 2.02 and uh hereby close public hearing item 2.03 okay thank you for that and

318then let me very brief reminder to everybody that an item 2.02 we're gonna call a special board meeting to approve the plan just to remind everybody we need to call a special board meeting for that before September 30th okay thank you for the clarification I was just gonna say on that can I um maybe recommend two dates and then us pick or do we want to text tomorrow and finalize that tomorrow uh can we do it offline sounds good I would prefer okay okay thank you I think as soon as possible right because we all have a schedule so if we could all know that we get to respond back tomorrow to come from those States okay thank you um so any other items besides 10.04 that need to be pulled from the consent calendar

319trustee Chavez 1005. 1005 okay um any others I'd like to pull 1010 okay um so any others don't see anything else so with the exceptions of 1004 1005 and 10 10 is there a motion to approve the consent calendar motion can you hear me yes okay by trustee Chavez all second the motion um so the motion is on the floor to approve with the exception of 1004 1005 and 10 10. I'll call for the vote trustee Chavez hi um was that was I yes I okay trustee Marquez hi trustee Quintero hi and myself I motion passes unanimously um so for item 10.04 um approved the Santa Clara County Treasury Investment Portfolio status I just wanted to see if covera uh Mr Chang could provide us uh or if he's there still um hopefully there is

320just a very high a very high level synopsis or summary of what that particular item is not only what it is but um you know is it how does it look for the district is it good is it bad is it trending any particular way so like a a general synopsis of what it is and what the implications this year for the district are so just just a high level um consciousness of how this program works um and surprise that law the county uh controller treasury's office um oversees all the cash of the school districts I believe all other local government um in this County as well um and what they do is that they they take all that cash and they put it in a poll which is called the Flamingo pool and out

321of that cash the County Treasury um has a team of investors um that invest in different um companies and whatnot well like a better word and based on any um any any proceeds that it yield or interest that is earned um it's giving back to the school districts or any agencies um based on kind of percentage of the cash that they have with the county um controller Treasures Office so um conceptually that's how the program works um to be straightforward I'm not Savvy enough with how they do their investment to be able to explain to you uh the trend or um how um I don't have the expertise in that um but that's that's the program that they have at the county controller Treasure's office um we do generate a lot of interest um Revenue

322uh from the cash that are being hold at the county controller um I've never seen an experience where we had any negative interest dollars that are being taken back from the school district um it's always in the positive uh whatever this particular pot of money get figured into our overall budget so for so let's say let's say at this point in time we have uh 10 million dollars sitting with the controller's office um and then you know there's other two districts in this County that has cash um that are that the controller is overseeing as well necessarily let's say a hundred thousand hundred million dollars um just for school districts Alone um that coach is used by a team at the county controller treasury's office um to do certain Investments That Could yield back um

323uh Revenue um is it like on a yearly basis based on those Investments do we see assuming growth do we see that money back in our budget or so we we yeah so every I believe every month they do a calculation in terms of how much interest and how much a yield is is earned um and based on a formula that they they put together at the county um or or proceeds yield uh back to the respective school districts based on the percentage of cash that they have in that Commando poll okay and then there's a go to individual fund or um a lot of the money goes to the general fund but remember we have different funds of the district so for example uh we have cash sitting in our bond fund um that

324based on that balance the percentage of that cash that the county is holding um our bonds program would be receiving interest Revenue as well um and so it gets Theory back not only to at a district level at a more granular level at the district so then they get allocated you know to the general fund to the um to the bonds funds to a capital facilities fund um based on a cash balance that you know that the county is holding for us okay thank you for that thank you for that clarification and for your acknowledgment that you're not your expertise is not uh the investment of the funds um can I get asked a question yes so um covera so this is um the co-mingling of these funds to invest is that correct yes okay

325what's our portion or what what are we in for how much what none well that varies by month right because yeah um in certain months our cash ballots could be at 10 million dollars and in some months it could be at 20 million dollars and it varies you know from month to month by district from District to District so uh it's hard to say how much our portion is um but on a monthly basis um based on how much the county uh is holding for us in cash um and whatever the interest Revenue um or investment yields um you know we get a portion of that money back to to the district okay okay because we don't understand I mean there's several of them several don't understand is there any way that we can get

326um someone from the county of Santa Clara to have been here so that we could ask these questions I mean it kind of put up a flag up on me for being you know your honesty on you know I'm not you know I'm not too Savvy enough um I don't have the expertise I'm like oops uh and I'm and I'm trying to grasp the understanding of this uh so I mean don't you think that we should have at least had someone here from Santa Clara from the county of Santa Clara to um ease our minds I guess at least mine yeah I mean we we can definitely make a request um although this channel the county and how available they are to be um presenting at you know at the district level so yeah I

327think what he said trust me Marcus is they can make the request and then obviously will depend on their availability to to come and be able to respond I didn't hear because I had you sneezed bless you I came on thank you so I'll make a motion to approve item 10.04 if there's no do we did I call for public comment no probably not is there a public comment on this item Mr Gill none okay thank you um any other questions or comments from the board huh number second oh I put the motion forward right yep sorry it's okay is there a second to the motion okay trustee Chavez vehemently seconds the motion so um we will call for the vote on this item trustee Chavez hi trustee Marquez abstain Quintero I and myself I

328motion passes four to one with one abstention trustee Marquez okay I don't know really quick before you move on I was going to jump in and make some comments about this item okay um but uh the vote had already taken off um I just the fact that people aren't aware as to what it is shouldn't be misconstrued by the public because it's uh as if there's some sort of uh something wrong or this is a service that's provided to the 32 school districts throughout the county um we wind up getting a very very good service for a very um low cost in terms of uh no overhead because of the fact that the county is processing it is part of the work that they already do the government requires them to do think about why

329the city has gone towards a route of tacking on uh for example the the garbage bill because it's cheap it's uh it doesn't cost any anything to do that and so I just want to make sure that people are aware out there the questions that have been raised shouldn't be misconstrued as to there's something wrong or something like that I just want to make sure to mention that okay thank you um so item 10.05 I believe trustee Chavez you wanted to pull that item yes um I guess it's because a lot of new hires and one of the questions that came to me was are any of these uh hires an I.T expert or do they have uh knowledge and Proficiency in I.T because I was asking Dr Bauer on August 4th if we could

330hire extra I.T help because I we've been hearing month after month that you know the connectivity issues and some of the parents not being able to log on and maybe you know the website uh problems that some people were having so is there any you know of those people that are being hired are any of them an I.T expert we have a lot of I.T experts trustee Chavez we share I share this with you yesterday during our one-on-one and I'm very grateful for the staff that we have currently you perfect marked um the people that have been hired are not for I.T we are looking into some support but we have to look into the budget so as of right now that is not uh for today you are not approving any I.T there might

331be somebody you know some positions uh a position coming up but we're still not sure we really have to monitor our budget thank you uh I'd like to put a motion on the floor to approve this item just for purposes of discussion on it um is that a second okay I have a question okay uh before you ask your question I um I wanted to give a comment real quick or yeah a comment um which is that um I I you know obviously we have heard some comments from some parents about challenges as we've rolled this new all this new stuff out but we also heard that we had last Thursday I think 8300 of our students logged on so that tells me that even if there may have been issues we may be on

332the path already to to get there and I also acknowledging that we have heard anecdotal comments from parents I think sometimes um we also need to figure into that uh I mean I guess the term is user error sometimes the technology exists but the it's just the person may not yet have the ability to to do it on their end so it's not necessarily that it's an IP issue it's maybe more of a training or support issue that doesn't necessarily need to be an I.T person so I think we just need to be careful um you know thinking of these uh Personnel decisions when we hear things that are coming in as comments before looking at the bigger picture um but it is an issue that we should continue to monitor trustee Chavez uh your

333comment yes I think because of the thick Matt did bring it up it is a bigger issue sometimes when you do all these hires then it doesn't free up money to get somebody to maybe improve it I mean you can always be improving what we have and that's it thank you okay so there's a motion and a second on the floor is there any public comment on this item there's one Veronica okay once you there you go once you begin speaking Veronica your two minutes will begin great thank you and has some great thank you um and as much as I also want to move forward on and get everything done um I do want to stop and acknowledge your comment um president um even though around almost 90 percent or even higher of the

334students logged in it does not mean that there's other challenges going around and that user quote-unquote issue yeah um it feels like you're categorizing it as like putting the blame on the person and I do not appreciate that I know many of our families are struggling with the language and now with technology so I asked for some compassion on that and if we need more I.T persons to go hand in hand and teach people how to do it then that's what we need and that's what we need to get our families um again I do not appreciate your comment um it just didn't feel like you were empathizing and showing compassion towards our family and I want to make sure that it is something that we are showing and that it is at the Forefront

335of what we're doing every day thank you thank you any other comments Mr Gill and one granddadas in the house okay Mason the house when you begin speaking your two minutes will begin I'm gonna ditto what um Veronica said I think that we need to be careful when we speak on General with all the community because there are a lot of parents still struggling with the language barrier and I just want to remind you guys that we only have two translators for the whole District we have 78 percent a Latinos in this district and we only have two um Spanish-speaking translators I'm sorry in one Vietnamese that's three and um we need to hire more translators to get to a lot of these parents that do have a language barrier um so I just want

336to suggest that we look into that to better support our community thank you thank you any other public comments Mr Gill um okay so we'll go ahead and call for the vote on 10.05 trustee Chavez can I say one more thing before we call for the vote Yes yeah okay you see how you see all this weird stuff going on top like there's a cloud above that's your that's your background no clearly that's not my back it is if you if you go on your they're like like a hollow effect there's a lot of people with a lot of connectivity issues and I think yeah you know for you to say oh it's user error it ain't user air come on you can see for yourself there's no way I could be doing that but

337anyway in this instance it is very clearly user error as far as I can tell that's a zoom background and it's uh president right now so let's go yes okay that's my vote I mean I think I think your your situation that I see on my screen is a perfect example of what I'm talking about where it is user error in fact that it's causing this and not I mean I could be wrong I I stand to be corrected but that looks like a zoom background that can be corrected with a couple clicks of a button so um but I do think that I do take the point and you can be wrong and you are wrong that's it thanks uh I mean I won't say anymore but I just I will address I will

338address address just um you know the point that this is not my comments are not about blame my comments are about making policy decisions and financial decisions based on um you know without without minimizing the concerns or or the challenges that some people have at the same time as a as a policy maker we need to base our decisions based on a number of factors and a number of realities that may exist and so I mean if that is felt as non-empathetic you know I appreciate that sentiment that's not the intent behind my statement trustee since we're all commenting uh during our uh vote I just want to call all of our constituents I know um we had vendum internet we only have two um I just want to highlight there's some big organizations like

339the county who doesn't have any um translators zero for the entire County and I can say this because they called me you know as an as an employee at one of their meetings to come help translate which I'm happy to do um but just want to highlight that big agencies like Santa Clara County have zero for their meetings County Board of Supervisors and we have two not enough but we have at least two so with that uh yes I okay um trustee Marquez hi trustee Quintero hi and myself I and so most passes five to zero I think I might be having some connection excuse also because it looks like my zoom background mysteriously popped up when I pushed the button but no I think it's the user it could it could be let me

340see I know from here if you're having issues man oh looks like connectivity fixed I got better connectivity okay no we just haven't I'm just having fun we I mean we all have challenges and a number of different ways and I'm one of the people that has plenty of challenges of my own so 10 10 um we'll move forward trustee yeah I just wanted to um highlight this one no accident you know resolution to um character Education Month in October um and I just it got me excited when I read it because um you know I I thought to myself if I knew about this stuff when I was in elementary school where would I be you know and so it really gets me excited that our children are learning about this um and I

341just encourage us as a as a district that you know we don't just do it during October but the entire year and that our students have the opportunities to you know get involved in youth Civic engagement um and I also offer myself Dr Bauer you know if I can come in and just encourage you know I I see our future bright and um you know any one of us can be an elected official and conserve our community um you know with the best of intentions so I just wanted to highlight that and with that I'll just ask for a motion to approve this okay there's a motion to approve 1010 is there a second second second from trustee Chavez is there a public comment on this item Mr Gill okay so any other questions or
