001foreign and the president you sound loud and clear okay good you too so far the night is young [Laughter] okay at least I'm in an air-conditioned bedroom well that's nice it's warm today are we all here already um trustee Quintero is not here yet um but we have little is here oh is he oh okay sorry about that is he I don't see him here he's on the camera on and microphone on oh there we go all right on time is that all of it I believe so okay okay so let me get my situation ready here cool I mean um I've started we have technologically Tech wise we have everything all set and ready to go yes sir thank you and we have Mr Ruiz here Dr Bauer I see her name um so

002it looks like we're ready or there we go okay so I will call this meeting to order at 5 30 pm for the regular board meeting of June for June 25th 2020 um can we have Maribel please take roll today is a regular born meaning of June 25th 2020. at 5 30 PM members of the board in attendance president vice president clerk Andres Quintero president member Linda Chavez member Dolores Marquez frosto president members from Administration superintendent Dr Bauer present okay thank you Maribel so we do have a quorum tonight and this meeting is being video recorded um so those are up front um thank you everybody for for getting here this evening um as we've come accustomed to I guess I'll just note um in terms of public comment tonight there are multiple ways as

003always for public comment um they without having to explain each one individually I will just say I hope you can still oh there we go I will just say that if you go to our website at arusd.org and on the top left corner uh there's a little Echo you'll see a yeah a link that you can click on um that says I'm pulling it up here I forgot the exact words so in the if you click on that on the current board agenda you will see all of the ways in which you can participate in public comments if you send uh via text or email it will be read by one of our staff um and during the time period That's allotted for that public comment and when that time is up your they'll read

004as much as they can during that time period in the interest of consistency tonight and in the interest of um moving the meeting along and getting the things that we need to get done done as we have several large items or anticipated large items on the agenda if there's no objection from my colleagues I would like to for all of the items tonight consistently have a one minute um public comment time and a 30 minute cap on any individual item um so if we have consensus with that we can move forward to the next part of our meeting and I don't hear I don't hear any objection okay are you are you are you saying that the public can come and speak at um on on number four for just one minute any item one

005minute with a 30 minute cap because um as you know last month we had uh 50 um people speaking on one particular item I believe more on a different item we have at least two items that I anticipate a high volume of um comments I've been notified that we have a high number of um written or sent in um comments and as you know trustee Marquez last month I'm well last meeting I believe we were making decisions somewhere around one o'clock in the morning and so I would like for us to to be able to um handle business in a way that that we can make our best decisions as a team and and be respectful of everyone's time as well so that's why I'm I'm wanting to um without objection move it along okay

006so would you respect I'm used to having meetings until one in the morning that's what time my first uh meetings um started as you know 12 years ago so I'm not a stranger to being you know we're being up at that time with meetings but I what I do have a problem is just the one minute instead of the what normal three minutes or two minutes because I mean I'm I'm I'm very comfortable with two minutes um but to one minute I think that's an injustice to the public if they have something happens [Music] okay I have a question about um you mentioned 30 minutes when you say 30 minutes does that include the entire discussion of the board higher public statement okay because I know sometimes we tend to um talk so 30 minutes

007just for the comment public comment on each item correct a cap of 30 minutes okay and are you open to um if there's more people maybe discussing and um potentially extending that depending on the item and the time um I would like to get it set just right now for the entirety of the meeting to not have to spend more time later going back and forth um I anticipate that there will be more people and I too I'm um I'm not you know I'm it's not comfortable necessarily for me to limit that public comment in in this way however I believe that um one at least one of the items that we'll hear public comment on tonight there was a significant amount of public comment on that item last month so that makes me a

008little more comfortable about um about you know proceeding in this way and as I mentioned if you just do the math even if there's 30 minutes um I mean yeah 30 people commenting if we go two minutes each you know that's an hour and we have maybe two items that might be you know heavy items so that's two hours of public comment along with a budget presentation and several other important things tonight I'm just oh hoping to streamline our business tonight I just you see what you're saying and I was here with you at that meeting um and just like Marquez mentioned I you know and I wouldn't be open to two minutes I think I'm okay with the one minute um especially for the long items but I would you know not want to

009prevent anybody you know from speaking and I would just suggest that if there's more than 30 people um and I'm assuming that you would extend it for the Spanish speakers because then that would only leave for 15 speakers I'm proposing a 30-minute cap overall yeah no I would say um not like cutting it at a cap and or being open to extending it especially if there's 15 Spanish speakers I don't think that's fair okay any other thoughts uh trustee Chavez I just lost my zoom um thing so if I'm off that's the reason why I'm gonna try and get back on okay we can hear you and see you perfectly fine yeah I can't though but oh so I'm gonna I'm gonna mess with it and see what I can do okay okay any other

010thoughts you'll know why okay um you're the president of the board and so the intention is that you're gonna go ahead and uh facilitate degrees or move smoothly so I I leave it in your cable hands um if it's one minute and we have 30 speakers and that's a some good comments in a minute uh a a good thought can get out um previously it was said that um the meeting used to go to 12 volt that's not an allen mark that I want to go back to I we used to get it out at three in the morning I know because I was in the audience watching some of these meetings and seeing that there's the dysfunctional Rock um after midnight you're not probably making very um let's figure out how we can get

011good input but at the same time also go through the very very important things like the budget and those discussions that we have to have I appreciate that for seeking Federal and um again this is I I would not tend to want to do something like this naturally but I feel like as you mentioned that I do need to move the meeting along and I particularly say this because as we preached approach the wee hours of the morning last month I noticed that some of us you know staff and trustees were like you know pretty beat physically it was quite obvious and I don't want us to be late tonight making very important decisions when we are not you know in our best mindset and just in in regards to fatigue so um Mr Ruiz

012at this point I basically have to make a decision one way or the other correct may I make the comment before you go um on with um oh yes yes yeah okay so um prior to um to all of these meetings your parents were really upset you know that when the other presidents were here and none of you were here that their minutes got cut and they're and we went through an ugly phase um and uh and we still gave them their minutes you know we still gave them you know what was appropriate for whatever time and we as the elected yeah we did stay later you know because that's our job that was our responsibility and those were not bad meetings it just happened that like this agenda is full we had full agendas

013back then too so um contrary to what when my colleague is saying that those were bad times no I mean they've been good times and bad times I don't want it to make him look I want him to make it look like they're all bad times but I do want I do want on the minutes as to who is is is uh agreeing to do just the one minute for parents and those that um that are going to be fighting for parents to have more speaking time to be recorded in the minutes and I for one I'd like to give them at least the two minutes thank you thank you hey president I was not speaking to previous boards I'm talking about Patty Potter's time and when Marquez and hereda were here dysfunction dysfunction dysfunction

014okay that's fine that's what I was talking about thank you for that so with that so function dysfunction thank you for that commentary that's okay let's move forward Mr Ruiz um at this point I can basically consider all my colleagues input and make a decision is that accurate yes okay I mean I have a question for I have a question for Rogelio then go ahead Rogelio so does the president just um arbitrarily do that or does he um did Kenny call for the you know for a vote as to who wants to do what so a vote is not necessary the board bylaws say that uh the amount of time on any agenda item shall be limited to 20 minutes so in this case I'm hearing that there's a lot of public comment and there's

015a desire by board members to allow for more public comments so 30 minutes is actually more than what the board bylaws require and then with respect to individual speakers um uh all the bylaws say is that with the board's consent um yeah you can move forward and change the time or limit the time about individual speakers so what I'm hearing is that it sounds like there is at least some general agreement on uh limiting the total time 30 minutes and and seeing on a flexible basis how many individual speakers there are on any given item so I haven't heard anything fast uh anything that the board president has said that he's going to implement is a hard and fast rule no not at all do you understand my you misunderstood my question my question was

016just about this how the decision is made one yeah yeah and I only went in and I wasn't concerned about the 30 minutes I was concerned about one person wanting to speak and having having to at least have two minutes not the other stuff so the question being I guess uh Mr Ruiz is it do we vote on it or does is it I mean how do we make this final decision and move it along here um you know if there's so a member is free to make a motion to to set the amount of time on any individual speaker nobody's made a motion on that yet so um if there isn't going to be a motion in a second then I would say just proceed and then call it with a 20 minute okay

017then I like to make the motion right now president I know that we give our speakers two minutes okay um there's a motion on the floor to give two minutes and in which case I would most likely go with our 20 minute cap that's in the board bylaws just to move things along um is there a second to that motion I don't see a second do we have do we have to uh trust each other's on or off right now I just want to know who is on everyone is on can you hear us okay so is there another motion so she did hear it though right she heard it there was no there's no second to the motion so will you be will you be asking the community for input no I'm at this

018point I'm asking for a motion any other motion from the board I can make a motion too can't they Mr Ruiz okay I'm I move I move that we go with um a 30 minute cap which is longer than our normal cap and allow one minute per speaker to allow the maximum amount of speakers while keeping within a reasonable time limit second okay there's the motion and a second on the floor for what I just stated is there any further discussion on this or can we put it to a vote no I'd like to discuss that one because I think that it's being very unfair to the community because there was an item that I kept getting calls about here that was supposed to have been an action item and you you put it on

019for discussion only and um it was um I had people that were very very upset and I said you just have to be in in the meeting tonight and that's all I said so hoping that those people that are on right now that are there for that item that was not put on as an action because you as president put it on as discussion and now you as president are only allowing them to speak one minute and not two after this vote is taken and uh and I hope that they're listening and that they chime in at one point or another thank you okay any other questions or comments um and I just want to make sure that um I uh my position I won't be voting for that as I think it's important to

020let our our community speak if we have more than 30 minutes but you know hopefully we're able to run smoothly but that we don't limit our um public I think um you know sometimes we as a board end up talking a lot so yeah I just hope that you know we're able to get through the items quickly um but yeah I won't be supporting this okay any other questions or comments on the board okay so we will put it on to the vote the motion on the floor is to have a 30-minute cap at one minute per public comment for any item on the agenda tonight um there's a motion in a second so I will call for the vote as I see you on my screen trustee Chavez hi trustee no trustee Marquez no

021trusty Quintero aye and myself I motion passes so we will extend the overall cap beyond our normal 20 minute limit to 30 minutes but it will be one minute per item and we can actually utilize the technology that we have available to us for those on Zoom if you hear a particular comment that you are in agreement with please feel free to use the um Applause or thumbs up sign to give us an indication of where the support is and also feel free to um when you give your public comment to in order to preserve time for others if you agree with someone ahead of you to Simply State you agree with point a b and c and that will allow us to hear more comments so I appreciate everyone's thoughtful discussion on this it's

022a difficult position to be in but we do need to be mindful of the business at hand as well who did the second on this motion um do you know who the second was on this was it trusty Quintero I don't remember it was um okay so thank you everyone thank you um so let's move on now to our Pledge of Allegiance um and so as I always stay because of the conditions of zoom and everything if you're able to stand please do so and if not you can remain seated and follow along with us um okay pledge allegiance to the flag of the United States of America and to the Republic and justice for all okay thank you so we can move to item 1.02 discussion or modification of the agenda I'd like to

023move and Pull 7.05 and move it up to after the comments from all communication after 5.06 705 to after 506. let's see correct uh trust you but I don't know our board president but I don't know um I would ask that we move our conversation related to the budget right before that item because I think it's important for folks to be informed about um our expenditures in the district so that we can go ahead and have a clear picture by the time we get I know that the item has a lot of interest and I know that uh the budget discussion will provide a lot more information to the public okay um if we have it before that uh the 7.05 so okay so are you speaking to um 2.02 or 3.01 you know the

024idea here is to have it before we hear 7.05 Quintero got you so you were trying to move it to 5.06 so all right cool um disregard I just wanted to make sure that that 7.05 didn't get ahead of the budget item no it won't yeah if budget is before that but I I thought I heard you to say that you wanted it directly prior to the yeah I think that it will be helpful so if we move 705 right after the budget discussion um that's my intention to have it paired up so that we can go ahead and have those who are present to hear 7.05 um get the benefit of uh hearing all the budget items right right next to each other so that there isn't a gap uh the attention is lost

025okay um trusty Marquez are you um I mean yes and I would like then I would like that 7.05 to be moved right after 2.02 301. I'm sorry trusty Marquez is 301. is he given the presentation after 20 yes the budget presentation is right after 202. then that's where I would like it before we take action on the budget after 202. after two or two but prior to 301 then just to be clear prior to taking taking the boat count okay 705 after 202. and just prior to 301 correct correct okay okay I see no objection to that any other modification proposed modifications Dr Bauer we need to pull item 201 just for uh July meeting and we also need to pull item 701 for the July meeting okay 201 and 701 pull from the

026agenda any other request to modify was that 701 and 202 201 and 701 I mean 201 yes we're pulling it off the agenda until July meeting yes that was my understanding yes that's what I heard thank you okay and uh Mr Chang you're muted can we unmute him Mr Gail if he okay we also need to pull uh 902 that's in relationship to the um Teamsters CBA okay 902 you said yes okay is there a reason why 701 theme fooled you said I didn't I didn't hear Dr Bowers comment you want me to explain oh yes please uh we are going to be working with the language trustee uh Chavez uh Rogelio and I um to be a little bit clearer and and I collected from all the one-on-ones you know with the board and

027so we're gonna bring something much better for the board to consider you know it's always for the board to consider on the first reading can I make a quick comment can we put the items that were in red added back to um that board policy I'll follow up with you on that exactly that's exactly what I'm we're gonna talk about that okay okay thank you I'm sorry you're my connection is some people sound like they're underwater so please forgive me if I have to have you repeat thank you that's okay thank you uh any other proposed modifications all right so you repeat it will you have the secretary secretary okay I can repeat it or Mighty Bell do you want to I have it here I think I'll I'll just since I have the mic

028open I'll just repeat what I have Monty Bell you can confirm so I have move 7.05 um directly after 2.02 and directly prior to 3.01 and I have to pull item 2.01 7.01 and 9.02 does that sound accurate yes that's correct just do the head on them okay so the 9.01 9.02 yes 9.02 is going to be put on the agenda for the July correct correct all right thank you okay any others all right thank you everyone so please um if I as we move through tonight's agenda if I skip something please remind me um but I'll try my best to keep an eye on that so um we pulled 201 so we can move forward to item 2.02 proposed 2020 2021 budget adoption um so is this I need to open up the public

029hearing okay so I am opening up the public hearing um okay so now you can go into seven or five okay what's the hour on opening it 5 56 P.M so thank you okay so now we can move forward to item um I don't know what seven point seven oh five five yeah correct okay let me get this up and uh after this is this was the item that I was talking to you about previously so um so we will um if we have we do have public comment to be read on this item correct Mr Gill do we have items from you on this item to be read yes there are 30 emails on 705. and what about tax or through Zoom text we have how many do we have of those trusty I

030mean Mr Gill roughly there are two hand raised three okay two three for now I assume that will grow um so I think what we will when we do public comment here shortly um to try to give people equal opportunity will um we will go back and forth from the the written written feedback that we've received maybe five five in a row of the written ones and then we'll allow for five hand raises and go back to the written ones to to try to evenly distribute um the public comment among those between those two uh methods does that sound agreeable to everyone just so we can make it fair to those who wrote and to those who are speak uh will be speaking okay so that's what we'll go with and we'll do them all

031at once um can I ask something yes did you know that there was already over 30 emails when we started I did not know the number but I assumed it would be a high number that's great okay let's do this let's do that okay so this item um is on the agenda for discussion tonight information only um and the right the reason behind that it it came to us as a request for Action to cancel the contract with the school resource officers um however the reason why it's in front of us as information is because the contract the contract expires um basically in five days I believe on June 30th if my dates are correct so the contract expires in five days and in order to cancel it we need to give the contractor 30

032days notice of a cancellation so by the time um that cancellation from us would go through would go through on track would have expired 25 days prior um and it's looking that due to budget realities of the district we are not looking at this time unless something changes tonight I guess we're not looking to move forward with this contract simply because our budget realities everything going on will not allow for it for this coming year so that is kind of the context of why this item is on the agenda as it is primarily a function of budget and the timelines within the contract itself and Our obligation to inform or provide 30 days notice of cancellation to the contractor Dr Bauer or Mr Ruiz does that sound accurate have I represented that accurately I think

033so okay okay so that um you know that's kind of a a framework or or a explanation of why it is in front of us tonight in this way so with that being said we can um I guess we don't need a motion to to have so yeah stressi Chavez I would like to make a motion that we don't have them come back for the consecutive year we don't we can't make emotions we cannot make a motion on it tonight because it's agendized as information only so tonight we can't make it so a request for next month to not renew for the next I know we're not gonna have them for this year but for the next year after that uh I that's what I would like that could be on the agenda as an

034action item at the time of um yeah you can make that request of course okay I do want to clarify for everybody that most likely this is concept won't be coming back to the board for at least three years this budget situation is very very severe and if we're gonna reroute the funds to other services remember services are not purchased not purchase Dr Barry can you repeat that services are not purchased what remember that if we are going to reroute These funds to provide more services in terms of student and Family Services which is kind of the the spirit of this you don't we don't purchase those services for one year only right so we need to be able to make sure that those funds will be used for those other things that we're going

035to be offering and it's not only going to be a one year only so I can't tell the board right now that this contract is not going to be coming back to the board at least for the next three years and I don't even know you know what what the future holds so I just wanted to be very clear with everybody I've I've said these kinds of things during our l-cap meetings that once the funds are you know allocated for something we need to follow those cycles that we cannot be purchasing one thing one year and another thing another year and another thing another year so it would going to reroute that amount to provide more support services better SEL restorative justice all of that right it's not a one year only commitment we have

036to continue those services to see that there's there are outcomes I just wanted to to be very clear with everybody thank you trustee Chavez I would like that still in writing please okay so mate you could you could still um propose it as an agenda is that impossible um but yes would that be something Dr Bauer that you would talk um individually with with or do we talk about that this evening so you want in writings can we just bring that as an action item next time to have it in writing that of course we're not going to have a DC or but the consecutive year as well you can propose that yes so we can okay put that on so we can vote on it then thank you thank you uh you're kind of

037breaking up maybe if you get a little closer to the mic but go ahead trust is this better much better okay this one and I'm not sure are you planning to present or it was just an announcement and I'm going to public comment okay so I just want to remind you know us as a board you mean we had this discussion over about maybe a year ago um I was one of the few that were you know against having officers at our campus so when we have this discussion hopefully you know it doesn't come back and as you know Byron mentioned maybe the next three years um and that when an if it comes back that we remember you know um and that we we uh look at you know data and that we have

038a um decision that's based on real information versus kind of you know where we're getting pushed just a reminder to all of us right um these times we're getting pushed you know and as systems in place uh we're being forced to look at um maybe we we don't we wouldn't have had these conversations about but um just reminding us that uh when we make decisions you know that we stick to them and that even if it comes back in two years that we remember our experience I appreciate that trustee I think that's um it's a why statement and I'm actually I think be speaking a little bit to that tonight in our discussion so I think um I appreciate those words uh Chavez I see your hand um when I made the decision um I

039was given only a certain amount of information and I was uh looking in on those things asking parents asking people and the way it seems now it's like um I think that money would be spent better on on other things and we can later discuss that but um that's um my opinion now that I know a little bit more about the sros thank you okay so now that we've kind of just framed briefly the the conversation a little bit I would like to begin to take public comment on the item um so it's six well I won't start the clock right now but once we begin talking we will have um 30 minutes for public comment one minute um I just wanted to let you know that there are 50 emails now okay so can

040can um can we make sure staff to that I mean not as individual emails but is there a way for you to aggregate all the emails that we get tonight into one zip file or something and and distribute them to to the board so that we can see even if we don't like likely we won't get to all of those tonight but we can still have those for our review and consideration I don't have the info after has the text numbers I mean my point being is that I don't think we're going to get to all of the written stuff tonight but I do certainly value that and I would like to read each and every one of them so if we can get those in some format then I would appreciate that Avatar I

041saw you with something and then trusty Chavez if you have something and then trustee Marcus okay okay thank you you mentioned yes we can accumulate all those emails and zip or as a PDF PDF might work better thank you trustee Chavez um you know how you said about Aggregate and all the emails can we do that from now on going forward with all the emails so we can see okay because I know we're gonna if we're going to be limiting on time I still want their message to be uh thought upon thank you yeah I mean I think as a practice at least while I'm sitting here um I don't I wouldn't in envisioned limiting every time is just when we have you know agendas with packed items it becomes a reality but I do

042think that your your idea is good and I also would like to to see that when we get written um communication and feedback that we just accumulate aggregate all of that make sure that as trustees we can consider all of the the community feedback that we receive Mr Gill and secondly speaking uh these emails can be live forward to the board members email accounts also so for future board meetings if it is request we can do that too okay forward to your emails so that we can have them for consideration during the item correct including the board meetings all can be lived maybe we could talk about those details offline sure um trustee Marquez I want I know trustee Chavez has something else but I trust you Marquez I know you were let her finish

043never finish okay I'll get them offline I don't want the meeting to go so long go ahead okay thank you Marquez so um in this item my concern with it from the beginning and why I wanted it to move it forward was to discuss and and and hear from our superintendent and staff as to what we're going to put in place because when these children are back in school we have to have something in place and no one has mentioned anything we can't take something like safety away and then not put anything in place yeah so my concern is is getting getting start talking right now it's on the agenda for discussion what exactly are we looking at you're you're taking it away because of budget constraints so now what are we going to do

044yeah I I also appreciate that um trustee Marquez and I'll have I actually have a request I'll be making tonight of staff that may speak to that because I agree it's a it's important you know it's Our obligation to provide Safety and Security to not only students but staff and visitors and so we should you know this should not be something that we just dropped and that's it we should we have the responsibility to build on that so thank you for that um so can we at this point begin begin but why don't we why don't we uh public comment let's read five of them um there's one minute intervals and then we'll take five raised hands and then just kind of alternate for now um if that if that's okay with everyone and Maribel

045okay perfect so is is um let's see Mr Sanchez are you going to be reading those emails again tonight I will be reading the emails okay so please um whenever you're ready just begin reading at a at a regular or slightly increased Pace to get as much as we can as needed and at one minute mightybell will inform you and you can go on to the next one and we'll do five of them for now thank you your board members as a San Jose resident and parent to a future student of color I emerging you to discontinue the district's contract with San Jose police department and remove all officers from school campuses school-based officers Target students of color and students with disabilities that are not proven to increase school safety the money spent on these

046officers should instead be invested into resources proven to support students and increase school safety such as mental health counselors just as black people are being unjustly targeted by police in the streets the same is happening to black students at schools black students are more likely to be arrested face police brutality and funneled into the school-to-prison pipeline on the other hand data shows that the president of school-based mental health providers improves both outcomes for students and overall school safety if you truly want to create a more just and safe learning environment remove all law enforcement officers from school campuses and invest the money into students well-being thank you Amanda Henry perfect thank you dear superintendent Bauer and Board of Trustees my name is Simone um and I am proud resident of East San Jose today we

047the community demand that you take a step towards a more Equitable school district for all students by taking action to support our black students and other students of color our black and brown children are not criminals armed police on campus only create an inordinate degree of fear among students and contribute to the feeling of less safe immigrant students are also particularly vulnerable to school policing as well as immigrants and undocumented students are pushed out of school and into the criminal justice system and are at risk of detention and potential application proceedings because of school policing and heightened surveillance students with behavioral disabilities are also at a higher risk of involvement in juvenile justice system in the school year of 2015-16 alone students with disabilities represented 12 percent um is that it did I finish that

048sentence of the overall student enrollment in the United States and 28 of students we can move on to the next one now Mr Sanchez thank you dear superintendent Bauer and Alum Rock trustees Dave we the community towards a more Equitable school district for all students by taking action to support our black students and other students of color our black and brown children are not criminals armed police on campus only create an order a degree of fear among students and contribute to their feeling of less safe immigrant students but also particularly vulnerable to schools policing as well immigrant and anti-cremented students are pushed into out of our schools into the criminal justice system and are at risk of detention potential deportation proceedings because of school policing and heightened surveillance students with behavioral disabilities are also at

049higher risk of involvement in the juvenile justice system in school in the school year of 2015-16 alone students with disabilities represented 12 percent of the overall student enrollment in the United States and 28 percent of students referred to the law enforcement or arrest another example of the disproportionality um so this is a repetition of the last yeah so if excuse me uh trustee or Mr Sanchez I don't know who I addressed this to if it's like a script and if it's already been read uh I know you have to decipher it ahead of time but can you move on to the next one because if there's 50 of them and if there's like five of them that are it's already the same uh verbatim um uh point of view can you go on to the

050next one but also mention their name this person said that that person said that so that that way we can have how many people did in actuality send the email and and so that their name can be heard as well please is that is that possible I think that is a good idea Mr Italy's we can do that correct yes so why don't we go ahead and do that um exactly as trustee Chavez has suggested for um any other emails that come up in that way what did what did uh Mr Ruiz say he was on mute but uh the question got cut out on me so basically because there's um comments that are kind of in a script format um in in the interest of trying to get as many comments in if if

051any come in like that the person the person that they have an identical or similar email and they're in support of that um idea yeah I think that's fine given the amount of comments you have okay so why don't we go ahead what about what about disclosure of who wrote who who uh sent that yeah we're going to give the name of that okay thank you thank you okay go ahead Mr Sanchez okay I will try to decipher that as quickly as I can um next one dear superintendent Bauer and Alum Rock trustees as a member of the black community and a graduate of the Alum Rock School District we demand the following action voting items on your next scheduled board meeting eliminate all contracts with SRO police this applies not only for school resource

068increases the chance of students dropping out it's even worse when we are dealing with younger children who are experiencing these kinds of conditions during a time where their brains and their development is happening and according to the Department of Health and Human Services office of early childhood development this is the time where young people realize um what are what's hormone but it's not we and they actually stated that suspensions explosions and these kinds of practices should be limited and eventually eliminated thank you Mr before you mute Mr Vasquez um I just wanted to ask a clarifying question Mr Vasquez can you um please just give a brief repeat or clarification on your your point around Zero Tolerance policy I didn't quite catch that thank you zero tolerant practices and disciplines include suspensions explosions contact with

069law enforcement and Central through authority of school discipline so it's a system of many different things that we are talking about here but but the statement is that suspensions and expulsions are zero tolerance policies is that suspensions and automatic suspensions and expulsions are part of that process automatic okay I think I missed the automatic part thank you for the clarification okay next person is Alejandra Flores okay yes can you hear me oh yes so once you begin speaking you're one minute or one minute hello my name is as an educator I'm here to voice my support in the demand from removing police and giving them out of schools as it strengthens the prison pipeline having police on campus is a form of psychological warfare since police intentionally discriminate and intimidate are black brown and immigrant

070students allocating These funds to something other than the police should solve your problem and finding ways to keep these students safe any decision that results in police funding is you failing to serve the very community that put you in this position either you step up and do your job or you step aside and let someone else do it right thank you thank you Mr Gill we have the next one and just as we wait um I'm gonna go ahead and just um if if anyone if no one has any objection to this um just due to the technical you know delays in this process um we were according to what we agreed to we would be finishing public comment at 6 45 but I am um I am suggesting that we extend to 655 just

071to account for the delays in the technical aspect of what we're doing is anybody you need emotion I don't think so okay does anyone disagree with it I agree okay um and I believe I I'm accurate I believe we started at 6 15 or 6 16 so um I'm comfortable going to 655. okay Gail I think this is our second one in this round it was and now the third one okay Espinoza hi yes uh can you hear me yes so once Maribel can you start his clock when he starts talking so when you start talking Mr Espinosa your clock will start okay hi uh my name is Tim Espinoza and I have two students in Alamo School District you know I'm sure that I can speak for most of the members on this call

072that were disappointed in the Cowardly decision to not place this as an actionable item for tonight's meeting and limiting our speech it's clear that the superintendent and some members of the board are afraid to take a stance on canceling uh contracts with sjpd and the Alum Rock School District many other school districts have taken a position and have made proact and have been proactive in listening to the members of their community and making sort of change there's nothing to debate about the negative implications that sjpd has in our schools there's nothing to debate about the parents who want the board to take action there's nothing to debate about how data from our district shows that are black and brown students are over represented in police involved incidents in our district it's time to act not

073in three years not in three years comfortable now anything less is complicity thank you um I believe one more Mr Gill yeah two more Grant hi um my name is Eric can you hear me okay yes thank you okay my name is Eric Grant I'm a teacher in aarusd um specifically at Renaissance at Fisher I want a second in the concept has been made thus far I do not support the presence of police on our campus and in our schools but I would also like to offer an alternative model for what it could look like if we're able to use those funds elsewhere I'm a teacher at Renaissance of Fisher where we have implemented restorative justice practices that meant that in my second year as a teacher and I'm a white teacher for relevance when

074a student of color slammed his fist into the wall next to my head I was able to instead of calling the police or asking the office to call the police I was able to take context from the community meetings I'd had with that student with the rest of my classroom Community I was able to work with him and work with his family work with the other stakeholders so that he felt that he was able to participate in our classroom moving forward he and I have built a relationship through those meetings that can that persist to this day he has visited me every year since he's graduated and that kind of practice and those kinds of meetings need to happen more in arusd and instead of having police do the work that teachers already want to

075do thank you very much sorry I just wanted to make a quick comment uh thank you Miss Grant for working with the student and you went above and beyond thank you so much thank you uh Mr gillets to go ahead and do number five yeah Maria Martinez okay Miss Martinez when I think you know once the your microphone is unmuted and once you begin speaking your clock will begin thank you good afternoon uh trustees and superintendent Empower uh one more time my name is Maria Martinez and also I had one son and and the Matson at one grandson in Koreatown and one is in San Antonio and another niece and Madison I want to ask you one more time again to please end the contract with the police and to invest that money and programs

078contracts with sros Slash police all right thank you dear superintendent Bauer and Alum Rock trustees my name is Vita Grossman and I am a San Jose Community member today thank you for the community demand that you take a step towards a more Equitable school district for all students by taking action to support our black students and other students of color um the same statement that was shared earlier um and please eliminate contracts with SRO police here board members I am a parent of three children who have participated in arusd elementary schools and middle schools the youngest will be in seventh grade this fall and has been at Adelante dual Language Academy since kindergarten I am joining many other others in demanding that contracts with school resource officers and and police be canceled as one step

079you can take to support black and brown students on campus in their fight for equity and Justice this is not about good or bad people or police but about an institution whose purpose is to maintain the status quo protecting slavery segregation discomfranchisement and economic inequality reforms and bias training will never be sufficient because the purpose of the police is counter to the interest of the majority of people in this community this year my daughter did not get to participate in the after school programs at Adelante though she has been in the program for the last five years I will stop there okay was that five or do that's not all right okay but that was fine I thought we were on four okay uh Mr Gill can we go back and do five more of

081be spent with for other things like Counseling Services uh one-on-one services and extracurricular activities thank you next one is Julia Barb Julia um Barbara okay yes um uh once you begin speaking Miss Barbara uh your clock will begin for your one minute hello my name is Julia Barba and I'm here today to share my support for no police or school resource officers on Alum Rock unified school campuses and for the district to cancel all contracts with the San Jose police department and all police now and indefinitely and call it as an action item students parents and community members are sharing their stories and voices today because of the first-hand experience and harmful impact that police has on our school campuses there is no evidence that states police on school campuses improves the safety or well-being

082of students and in fact police on campuses do not make students feel safe leads to increased criminalization values should not be on discipline and security educational environments for students it is disrespectful to continue to disinvest in the resources that Alum Rock students need funding should be used for mental health services school councils counselors restorative justice programs and culturally responsive services for students that are determined by parents students and families doing this is an alignment with the American public health association's recommendation to reduce police violence and to investment programs thank you Miss Barbara for your time your one minute is expired thank you very much I apologize for having to cut you off Mr Gill can we move to the next person and understand it what was that one Jacqueline Franco okay Ms Franco once I

084or maybe two or almost three okay Julia okay Miss salza um Larry D'Souza um once it looks like you are mute unmuted so once you begin speaking your one minute will begin hi my name is Julia Souza I'm an attorney at law Foundation of Silicon Valley legal advocates for Children and Youth uh we represent low-income students of color throughout the county but especially on the east side and especially in Alum Rock um I was glad to hear that Alan Rock will no longer fund place on campus due to budgetary concerns in this time of economic uncertainty arusd needs to focus on supporting children and families and not criminalizing them but cutting the contract is a good start and it's but it's just that a start arusd needs to continue to implement wholesale reform of all

085School interactions with police especially when staff are calling the police on students with special needs Lacey and the law Foundation stand with the community on this issue thank you very much one more Mr Gill excuse me she said she was from Lacy Julia Susan yes Susan she said she was from where yes Lacey okay thank you my first name is Alondra Arroyo okay Miss Arroyo when your microphone is unmuted you will have one minute once you begin speaking okay hello I am Alondra a youth organizer with ebook I just graduated high school from the San Jose Unified District I however was an allen Mark School District from elementary to middle school we demand that you terminate your contact your contract with sros and stop allowing any law enforcement agencies on campus please end the criminal

086criminalization of students and dismantle I was a student who would fear walking the school after having many encounters with police following me to school trying to intimidate me and then seeing them on campus where I am trying to study especially in this time of History where us colored people are being targeted what makes you think it is logical to bring in policing into our school especially with young children eliminate all kinds charts all contracts to us with sros and police and stand with us not against us thank you and please with the privilege you have being on the school board stand with us thank you very much Miss Arroyo um so thank you avatar for those that was five correct okay so regardless of the time I know I said 655 but Mr Sanchez if

087we can just um do five more of these and then unfortunately that will be um the time that we have for public comment on this item um with the exception of what we talked about sending all of the written communication to the board so Mr Sanchez whatever time it takes for you to do these remaining five will be the the time even if we go past 6 55. president I know how many are left in the email uh how many emails are left Mr Sanchez um we had a total of over 50 emails in support of eliminating uh the contracts I've been reading through headers and we have about a little over 50. and we've read it how many are left how many are left there's over 30 left oh my God in front of

088it we're not gonna hear I for one and I I am thoroughly enjoying listening to the community's input and I I wish that we could continue for at least another 10 minutes okay thank you okay Mr Sanchez thank you um this is um uh dear superintendent Bauer and Alum Rock's trustees my name is Saeed ikan and I am a San Jose resident and father of two young boys today we're the community as we take a step towards a more Equitable school district for all students by taking action to support our black students and other students of color um the same statement that was shared earlier um was written here uh we demand action voting items on your next school board meeting eliminate all contracts with SRO slash police foreign Rock trustees my name is Blake

089Buchanan I am a special education teacher I am called to make this comment because the president of police in arusd schools has led to the harmful experience for students and families in some cases results of irreconcilable social social and emotional damage this is especially true for students with disabilities who are disproportionately referred to law enforcement today we the community demand that you take a step towards a more Equitable Equitable school district for all students by taking action to support our black students and other students of color um again sharing the same statement as I stated earlier we demand the following action voting items on your next school board meeting eliminate all contracts with SRO police I'm sorry did you say he was a teacher at Alum Rock um he is his special ed teacher thank

090you at Alum Rock I believe so yes thank you thank you Mr Buchanan uh this is Kenny Solorio as a former student of arusd and Eastside High School District I witnessed multiple times in which police in our schools mistreated us and our families I also witnessed multiple times in which our teachers and counselors made multiple racist aggressions towards black and latinx students we must not tiptoe around the issue of police violence in our communities and the culture of anti-blackness in our families schools and state institutions Rihanna Taylor George Floyd the shark Brooks Eric Gardner and so Ford Michelle q6 Tanisha Anderson Tamir rice Elijah McLean Oscar Grant Rudy Cardenas Richard Harper jackass Jacob Dominguez Antonio Guzman Lopez Richard Lua Isaiah Lopez Jesus Janae Montes Anthony Nunez Daniel Pham Aaron James Phillip Steve Salinas Diana Diana

091so I Tran Phillip Watkins um thank you all okay thank you very much everyone um you know again thank you all we um we're trying to expedite the meeting and in doing so um I believe we we kind of bypassed what we had set forth originally in terms of the order of the agenda and so the um budget item was actually supposed to come before this item so Mr Ruiz since this is a information only item I'm wondering if we in with through to respect uh Mr quinteros or trusty quintero's request earlier if we could go now into the budget presentation and then come back to discussion by the board on this item that we just heard public comment from that's fine okay and I apologize for the order getting mixed up and hopefully everyone

092um understands obviously the budget is a much bigger topic but there are ties to the topic that we're talking about now and hopefully it'll be an easy transition for people to come back to this topic so with that being said um Mr Chang are you prepared um and does he have the ability to be able to share thank you thank you hi can you hear me yes great thank you uh good evening board president um member of the member of the board um Community my name is covert Chang I will be presenting um the district 2020-21 proposed budget um with that some of the topics that we'll be covering this evening is um are some key events and timelines um the assumptions that the district used in developing next year's budget will be also going

093over the multi-year projection for the general fund um the statement reserves and what to expect next uh with respect to key timelines and event we'll start off with the um Governor Newsom um made revision which was presented on May 14 2020 um subsequent to that the Senate and assembly um reach an agreement on June 3rd 2020 um which was significantly different from what the governor had had proposed on June 15th at the Senate and assembly approved um the legislators version of the 2020-21 state budget um despite not having a an agreement with the governor um on report June 22nd the district's required to make available um it's next year's budget proposed budget for public viewing um to comply with the 72 hours requirement uh before the board takes action on on this item um on

094this same day um the governor Newsom and the legislative leaders reached a deal on the 2020-21 state budget um and this evening um the district is presenting um is proposed budget for next year uh which is based on the labor Vision um as prescribed by the County Office of Education so we'll start off with the key assumption first with respect to revenues um lcff is based on the May revision um and I'll provide more details um later in the presentation um the after school program also was using the May revision um at a rate of seven dollars and fifty cents per students per day um Statewide for special ed uh we're using the 645 uh dollars per Ada um with respect to federal revenue um the cares act has a few components the first one

095is the Esser money which is the elementary Secondary School emergency relief fund um for Alum Rock uh we will be receiving approximately 2.9 Million Dollars um I'm sorry go ahead um approximately 2.9 Million dollars for the Esser fund for the Esser e-s-s-e-r is the elementary and secondary school emergency release thank you um the second part for me is the Corona virus Relief Fund for learning loss for students with disabilities with disability um for that fun uh the district is anticipate anticipating to receive approximately 2.1 million dollars um 2.1 thank you and the last part of money um under the under the cares act um if the proposal that uh Governor Newsom put out where he would allocate that uh for only concentration districts um that's approximately uh 735 per Ada um this money is not

096included um in the proposed budget um as described by the County Office of that uh due to the uncertainties of uh how the money was going to be allocated or what it could be used for and then lastly any one-time money that we budget for 2021 will be taken out um in the out years um this next slide shows um yes go ahead thank you so what what do you anticipate the total to be um from the seven 735 for Ada with our enrollment with what we have today is our enrollment which is what like 900 and I mean 9 000 eight at 9006 yeah it's it's a little over six million dollars but I'll go through the details um later in the slide uh there's more information regarding that money and now in Roman

097our enrollment this year is about nine thousand one hundred and eighteen oh my goodness thank you sure okay so this next slide shows you um past and also future enrollment um as you can see the district is is continuing to project declining enrollment um starting with uh 2020 and 2020 school year uh where the districts is projecting to serve 8 934 um year 2021-22 8686 um and year 2022-23 8445. um this slide shows kind of the breakdown of how lcff is calculated uh the first line shows you the statutory Cola uh for 20 um 21 um the cola there is 2.31 and 2122 uh 2.48 um 22 23 is 3.36 um the second row here shows um what the state is proposing to do in terms of whether they're suspending the code or not um

098in year 2021 uh the state is proposing to suspend a cola uh which in essence reduce the total um deficit factor from 10 uh to 7.92 to the base Grant um that deficit Factor goes up to 12.18 in year 2122 and then uh 14 point a negative 14.95 in year 22 23. uh with all those factors um our lcf or total lcff um estimate uh comes out for both the districts and aptitude um in year 2021 um 92.2 million dollars 21 22 89.5 million dollars and then in year uh 22 23 87.2 million thank you so that those were the assumptions used for um Revenue uh we'll go into uh the expenditures next um in terms of expenditures um uh we're building in an increase in step in column for all three years um stairs

099and pers rate uh is based on the main revision we do not anticipate that on changing um based on the final budget by the state uh so that one's pretty constant um our contribution to special ed will also increase in the out years the reason why we didn't increase in the budget year is that one-time money uh from the federal government that's going to help subsidize some of the some of the costs there um and the last one on this on this list is uh we'll continue to maintain three percent contribution to our maintenance programs for all three years um the next set of assumptions um we're building in a reduction of 30 certificated ftes um at 85 000 average salary um for in year 2021 and an additional 20 certificated ftes um at 85

100000 average salaries for year 21 22. um the next sets of assumptions are negotiations uh negotiations are not settled yet um with both area nor CSEA for the current fiscal year and the upcoming budget year uh we have reached a tentative agreement uh with Teamsters um for this fiscal year and also for next fiscal year um the cost of that tenant of agreement has not been built into the post budget and then the base last three bullet points it's important to note that in order for the districts to meet the three percent uh reserve requirement um in year 2000 2021 uh the districts will need to make an additional 4.2 or what's created what's been built into the budget is a reduction of 4.2 million dollars which districts need to um to determine later um

101and then for year 2122 that amount is 16.2 million dollars and then for fiscal year 20 22-23 um that amount goes up to 22 million dollars uh which uh we still need to um which are to be determined still um when are we looking at the 22 mil uh in year 22 23 years ago thank you thank you okay so based on those revenues and expenditure assumptions um the first this slide shows you the multi-year projection for the unrestricted general fund um as you can see we're starting the year with the beginning for a projected year with uh projected beginning balance of 9.3 um and ending the year with um approximately 3.8 million dollars keep in mind that in this fiscal year we've already built in a reduction of 30 certificated ftes and the 4.2

102million dollars that essentially has been reduced in the budget already that we have not identified where those cuts are going to be um in year 2122 uh we're projecting to begin the year with 3.8 million dollars of beginning balance um and end the year with 3.4 again as a reminder in that year we built in 20 a reduction of 20 certificated FTE um and also um 16.1 million dollars of reduction that still needs to be identified um and then in year 22 23. 15 million approximately 16 million for 22 23. 21-22 okay okay thank you yes and then for 22.23 uh we're projecting two um start the year with 3.4 in reserve um and the year with uh 3.3 and again that's also uh building already 22 million dollars of reduction that still needs to

103be identified oh my God um for the restricted general fund a year projection um these are this this is the side of the general fund where we operate our special ed program our maintenance program our after-school program and all the federal um programs that we get money from the federal government um so total for total revenue including contributions in year 2021 44 million dollars and um again we anticipate on spending all the money that we received in that year for 2122 um total revenue of 41 million 41.3 and anticipate on spending that whole amount and then in the last year 22-23 um projected revenue of 41.7 million dollars and also spending um down the money that we're receiving from all those programs and then this slide shows you just a combination of both the unrestricted

104and restricted general fund um as you can see here total uh projected beginning balance is 9.3 million dollars total revenue um 123 million dollars um and ending the um year with 3.8 again as a reminder um this budget uh already includes 30 for this year already includes 30 reduction of certificate ftes and 4.2 million dollars of reduction that still needs to be identified um in year 2122 um projected beginning balance of 3.8 um and ending balance of 3.4 and this also includes 20 certificated ftes um and 16 million approximately 15 million dollars to reduction uh that still needs to be identified um and then in year 2223 um of projected beginning balance of 3.4 um and ending balance of 3.3 with a 22 million dollars reduction uh built into the budget that still needs to

105be identified [Music] um statement Reserve um every year that every districts are required to uh disclose um their fund balance anything in excess is a three percent requirement um since we're not showing any excess for all three years um fundamentally this is just a technicality thing so um it's not relevant to us so I'll be skipping the next three slides or just go in it over very slowly and then for next steps um what can we anticipate um so on or before July 1st 2020 the district is required to submit um its uh adopted budget to the County Office of Education um the district is anticipating that the enacted budget will be adopted in the next few days so that we will we will already be um starting um we're on the last page what

106number number 14. hey thank you okay so um the district will be revising um if adopted budget um in the next 45 days to reflect um changes based on the um inactive budget and so some of the biggest difference um that we're seeing uh right now um from the movie vision is that uh for state revenue um that 10 cut that the governor is proposing will go away lcff will be funded um at the 2019-20 level um however there will be no Cola for for next year lcfs funding um we're still waiting on information for what lcf is going to look like for year 2122 and your 223 um so that's going to be very significant in terms of um you know what other changes we might need to or what other adjustments that we

107might need to make when those information comes out um with respect to Federal revenues um we call that um the Corona virus Relief Fund uh the governors proposed to allocate that just for um concentration districts uh while the legislator wants to allocate that um based on the lcfs formula um the the final budget kind of land somewhere in between so they kind of split that money into two parts uh one of the allocations going to be based on a portion of the district's supplemental and concentration funding for all on block itself we're projecting to receive 5.5 million dollars um and then the other um part is where they're allocating based on the lcfs formula and for that the districts is participating on receiving 1.5 million dollars again I want to remind and emphasize that these

108um federal funds for learning loss are restricted for specified purposes and there is a reporting requirement for on for any unexpected funds that the district has um what we're waiting for is that we're expecting the Senate to take a final vote on a state budget um by today um the assembly is expected to vote um by tomorrow on June 25th and that'll be sent to the governors um where we're expecting to sign that budget off um on Saturday June 27th and with that um I'd be happy to take any questions Marcus unfortunate fortunate interrupting because I because I don't understand what he was saying it wasn't coming out clear at my end um so I would like to request that I get um a recording or a copy of what he was saying because there

109was no 14 page on my book and I tried to follow and there was no Federal um when he was talking about the federal money I kept looking for it I didn't find it so um this was a little complicated for me it was a little hard for me because I could not hear so I am requesting that I I do get a copy of what his report was thank you I think we can do that correct staff thank you okay and um just um I mean no no answer needed now but trustee Marquez I'm just wondering um if you'll consider in the coming month or two um I think we do have the ability and the resources to get you on a district laptop and get you all set up easily to be able

110to see this because I I know you are at a a disadvantage in some ways when you know when you're on the phone and I really would want for you to have the same you know the same opportunities that we all have to see the presentations and and you know all those things so something to consider potentially hopefully in the next month or two and I believe staff can easily set that up and and we can make sure that you don't miss out on on stuff that we're all getting so thank you I appreciate your consideration uh so any other questions or comments from trustees about um Mr Chang's report and thank you for your report Mr Chang uh I see your hand yes uh thank you colvera um and I did received um yesterday

111so I appreciate the outline um I guess one question just at the end of the presentation that just comes off the top of my head the covid-19 funding um I know you talked about it being specifically allocated for you know certain purposes um but does that mean then that we're able to then shift certain things so that um that would align if uh once received uh yes but they have to beat the parameters of what those funds are intended to be used for right I'm just saying right now we have certain things allocated but once we receive you know when if we receive that money then we can then shift money that maybe wasn't allocated specifically but then they would alleviate I guess um eventually or another are you saying that things that we currently

112have allocated in a certain way that would be covered by these new funds could then um free up those funds to be used on something else because they're now being covered by the new money right that okay I don't know if that makes it more clear or more eventually it's still a plus for us that that money will come in allocated for specific funding related to cover 19. I'm guessing you know we'll have those guidelines but then eventually because we had already allocated money the money that was allocated for those specific guidelines can be then redirected somewhere else yes but fundamentally that that is possible uh we're still waiting on cleanup language and clarification uh from the trail Bill itself um but so as long as um you know those funds are being used for

113whatever sets of purposes that has come down from the state uh we're allowed to um kind of shift those funds to pay for those expenses for the services for that only can you repeat that so that this is one-time money that's earmarked for only that uh is it restricted yes yes it is one-time money um and they have certain restrictions that we can use that money for any other questions or comments I have a couple of questions um first with respect to the the one slide that you had about restricted funds that we're drawing down to zero and projected in the next three years um you know which one I'm talking about yes okay so um is that typical that we draw down to zero in a normal year um and if not then what

114would we do if I mean I'm assuming we're just going to have to be very diligent to not spend past that but if we spent past the zero depending on how things worked out would there be some cushion in terms of how we would cover any expenditures beyond that which my assumption is again that we wouldn't do um and so I guess those are the two questions around that is it do we normally draw down to zero and I think I know the answer and then if we go beyond that what is the the remedy or the the way we handle that yeah so so typically on the restricted programs uh we typically don't draw down to zero we do have some carryover um that's pretty typical um but those carryover can only be used

115for um you know restricted programs um so they can't be shipped back to the general fund or the unrestricted general fund uh for any purposes that the districts wants to use that money for um it's a little bit of a background um the biggest program on the restricted side is our special ed and uh maintenance program um and our special LED programs um typically uh would receive a contribution from the unrestricted general fund um and that ranges from you know uh last this year alone it's about 18 million dollars that's the unrestricted general fund is contributing to um special ed programs um and for a routine maintenance uh we're required to control 53 from our unrestricted money into the restricted side and that's approximately Four Points four million dollars and we typically use all that

116money um the other big programs are the after school program uh where um even if we um don't spend all that money um any money that we have in reserve and carry it over to the next year we have to use it for that and then on the federal programs uh for example title one dollars uh you know their their certification that you can only carry so much from one year to another um and even in those programs um if you have carryovers you need to spend that uh based on the parameters by the federal government okay and then so I'm assuming that you know drawing down to zero there's not even a a razor thin margin there there's zero margin so I'm assuming that we just ensure that we don't go beyond that those

117expenditures and do them do then the question was how would we handle that um we yeah I mean we we try to be mindful and we do our best not and we haven't had to gone over what we receive and restricted dollars uh particularly for acid also for um for all the federal um all the federal funds um so we we've been maintaining or staying within um you know the easy amount doctors receiving so it's just a matter of matter being diligent in those things okay and then um the other question that I had with I mean obviously we're not unique in in the city when you know you we talk about this 22 million that's out there so is there right now amongst other districts or you know jurisdictions or other you know amongst

118your colleagues and peers is there any like what is the discussion about how people are thinking about this and and you know trying to get a grasp and and begin to plan out ahead is there any I mean it's pretty sizable obviously so it's hard to think how any of us are you know expected to plan for something like this right now and there's been enormous conversation um at you know the the CBO level regarding what plans they have in place um and a lot of the information right now is very um early um and as I mentioned in in one of the slides that we're still waiting on information for lcsf for year 21 22 and 22 23. um that's gonna um help us with our decision making in terms of um where the

119funding level lands uh for those particular years um obviously um if if it improves um you know we would have to I mean it it'll help the district out in terms of um you know what what what what adjustment we need to make um in terms of the adjustment itself um I think a lot of districts right now are struggling um with how student I mean with how school is going to open in the fall and that's really going to drive a lot of decisions that's going to be made in terms of um you know what adjustment we make to make we need to make um going forward um so there's a lot of things that's a very fluid uh um but we're I mean those are the conversation that we're continuing to have okay

120thank you thank you very much I have a question interesting Marcus is that you I think yes thank you okay go ahead hello you spoke about um the um there there was a cut of four million something cut um is that the cut that's going to go towards the eight or the 9 million that we have to address I'm sorry hello yes I don't quite understand your question can you repeat that well well I could I could not understand where that four point something million uh cut was because it were I couldn't understand you and um and so I wondered if that was a 4 point something Million Dollar on on the the deficit that we have to address and and what is the amount of the deficit we have that we have to cut

121is it eight million is it nine million yeah so so the 4.2 that I mentioned for year 2021 um that's on top of the eight million dollars that was previous mentioned um eight million dollars of the reduction that we've already built into in terms of reducing certificated conditions um in both 20 uh 21 and 21 22. um so over those two years um as we're producing staff in that area that would cover the uh approximately the eight million dollars that we initially had to um cut from our budget um based on the the the cuts to our lcff dollars for this year um the 4.2 is in addition to what we would need to make in order for us to meet our 30 requirement um and then so forth going on to the next year

122you know the 16 and the 22 um in the two subsequent years so so you know and I I wanted to ask you a little bit about cash flow that's that's something we can't even talk about because of the deficit we have we have no cash flow correct uh we we have enough cash right now um to cover us through the end of uh December you know with with the state proposal um what they're doing is that there's I mean the deferral is huge and so what every district is having to do now um is to issue Trends which is a short-term uh debt instruments to borrow cash for that particular year um to cover all of our obligation until um the state has the capability to pay us and so the proposal and the

123final budget is that um there are some additional deferrals that are going to be imposed on the district um and the deferral starts at early February um of next year um but we've done our cash flow projection um and we have enough cash on hand um to cover us through um through December but we'll need to look into uh between Trends in in the near future to cover the the amount of the pearls that the state is imposing on us I see and so and so then we're actually I I don't know how we're doing this so you are putting together the eight million dollars that we have you know we have these obligation to do right and you're putting it onto or tag it on on to the 2122 as well because you said

124the 4.2 is on top of the eight so that would make it 12 million that we're looking to cut no no so the the 8 billion was over the two-year period um and that would be taken care of the reduction of 30 certificated staff in year 2021 and um 20 certificated staff in year 2022. I'm sorry 21 22. and now the the million dollar question what got us into that deficit which one are you talking about well we already did the 14 million and now we're doing this this 8 million what got us into that you know what was it that it was we went into a eight million dollar deficit yeah and and I think the biggest issue is that the district is continuing to um experience declining enrollment and so that's taking away

125a lot of Revenue that the districts will be getting so uh the reduction is to align Staffing with um the projected loss of students that we're we're looking at for four years we know every year we've had a decline you know 300 or so students so how is it or 400 declining of 400 how is it that we did not start managing four years ago to prepare for the final the Knicks for the next year for 400 that you know it could have saved us to get us into this deficit that I don't know where it's coming from other than um it looks to me like the deficit I mean the deficit is going to be cut again on csda you know and they're like our lowest paying groups that's the lowest paying group I

126don't know how much you're gonna get out of that to apply to the to the deficit and if you can give me a number of how much you know I saw that there was eight you know ate them they were being cut correct correct are you referring to the resolution later in the board agenda yes I am referring to that because I mean I honestly if my community was to come and ask me he goes God what did you guys do what did you guys buy what did you spend that you have eight million dollar deficit all I can say is we lost kids well if you were losing them every year how come you guys didn't prepare for that why did you keep getting the deficit bigger and bigger and bigger I can't answer

127that because I don't know why the deficit got that big I couldn't even answer why we had a 14 million dollar deficit last year I mean you know when we when we when we cut that 14 million so I mean you all I'm hearing from you is that the children we've lost they cost us that money is that it that's I mean that's that's one of the reason why um you know the district has to make adjustment I mean losing students equal losing money I mean there's also increases natural increases in expense for example you know the stairs and per special ed all those programs um you know naturally goes up uh year after year and the state hasn't been able to keep up with the funding in terms of um on a comparable when

128you compare what the state is providing Us in revenue and the natural uh escalation in operating in school districts um you know there's a disproportionate where you know the expenses right now is exceeding uh it's outpacing what the state is giving us in Revenue um so that's that's another major reason why um and we're not the only school districts that are making these massive Cuts I totally understand that but the disproportionate that you're talking about for me is that I am looking at the cuts of being done in in in two meetings you know is being done with CSEA so I don't know how that can help us with those huge numbers because that's not what they cost us they don't cost us anything like that and so it doesn't have to drive it does

129not match you know and so for me it's um it's I cannot put it together when I look at it when I talk to my friends who are in the finances you know I'm going like does this make sense to you because he goes well what did you spend or what where what got you into eight million dollar deficit and I have to say I don't know I mean we're we're losing kids like everybody else is losing kids yeah well there's got to be more than that so if you recall in this presentation uh we're not only I mean we're also reducing certificated staff um I mentioned that we're reducing 20 certificate of Staff uh in year 2021 and an additional 20 certificate staff in year 21-22 so um you know it's not only one

130unit that is getting impacted from these reductions so is that is that in our binder in our book the certificated one yes is it because I all I remember is looking at the the sea one it's in the presentation yeah okay wait a minute in the presentation but not in the book that is that correct the certificated reduction are not listed in the book it cannot be listed in the book cover up because those had to have been noticed in March all we can all we can show in this book are classified cuts and all I saw was low low one hour people two hour people I saw very low low ones I mean when you got classified managers you've got classified supervisors you could other ones up there and I don't see any of

131those I I don't understand so is there one more specific question because I know trustee has a hand up and trustee Chavez as well well look because he's not answering my my concerns and let me tell you I'm just going to finish with I I'm I'm just addressing covera I am very very concerned that all we have for a cash flow is till December the end of this year and and and if my colleagues on the board do not understand what the cash flow does or what how it works then they really need to go get some training because that's the first thing I look for is the cash flow and this is very alarming and if people are listening out there you have something to be alarmed because there was no no response as

132to what got us to this amount of deficits every district is having these problems but we should have been preparing for them if this was an ongoing loss of ADA you know of enrollment that was going out I'd like to you know president if you do this to me again I'm really going to object I I respect you and everything but you know when I'm calling somebody on the rug and on the carpet because parents are calling me and you want to interrupt me before I get a satisfied question I will address you because this is very very rude of you but everyone tells me that you're very realized sorry that I saw it today you know I'm actually well I actually um just for clarification several I'm trying to look for spaces in in

133your comments I actually waited several times as you pause um so it's very again as I mentioned without being able to see you visually I just see a little phone symbol here so it's hard for me to determine when you are done or not so I apologize if that you know has impeded it in some way but you know it I'm I'm doing the best I can with the with what I'm able to see here and so and that's why I asked you a question for them small comments more common insane is this your are you done you know it's fine but to just go ahead and call a colleague of mine well I am still trying to not only inform the community that's on tonight but to inform myself as well because I don't

134get this nothing matches it's just a bunch of numbers bunch of numbers and nothing tells me what how we got to this deficit this district is not going to survive in the last four years look at all we've gone into deficit deficit deficit deficits I'm sorry I'm done I'm done okay thank you um so uh cover I just wanted to direct me on that the page of the actuals and then um the projections um where would the police um fund what area would that be covered under um which side are you looking at trustee I'm actually looking at our um book page one um just the projected the actuals and the projected the list where it talks about the expenditure the revenues and then breaks down the expenditures so I'm wondering in the expenditures area

135would uh the police funding be if when when we did put it in yeah so um it would be in your line item five thousand series okay um and and that would be where we've been paying for independent contractors in the past okay I just want to make sure that you know I follow it and then zero for the projected um you know three years as we discussed um and now I I do want to thank you you know I know Dr Bauer you've given enough time to um ask all these questions um and you know uh but I know just as a um as the peer uh uh District uh trustee here um I think maybe we should even you know consider uh putting a Time on our comments and questions just you know

136for future reference because I know a lot of times we spend a lot of time on our own comments and questions okay uh trustee Chavez um one of the questions yeah to Dr Bauer was we keep seeing the projections for the next year and uh we know for a fact that we keep losing 400 plus students so when we do the projections and it's only 200 on something so right off the bat to me that says you're not giving the accurate projections that have been every single year we've been losing 400 so and to me that's like a false number because you are not putting in the 400 you are actually putting in that we will probably be losing 200 and something students which will throw the budget off immensely and um I know that

137uh Dr Bauer told me that's the way the county did it or recommends it to it or I forgot Verbatim what she said I just feel that we need to be doing the actual numbers or or get uh an average of What has it has declined in the last five years and it's going to be 400 and something because it to me it makes it like we're counting on money that's coming in that's not and that gives false projections that gives a false sense of security if you want to say with the budget thank you and uh was that a question or um why do we keep uh making the projection that we're going to be losing 200 something students rather than doing the actual number the numbers that are being faxed we've been losing

138400 plus students every single year why aren't we doing an uh an average and taking that and doing the project and doing the projection and before before doctor was going to respond to that I just kind of wanted to also Echo that as well I think um but I think I you know I'm not sure if I mentioned this in in a public session or in a one-on-one but you know I think in the initial years it seemed like it was you know we were projecting and being kind of um you know as as trustee Chavez is saying we're projecting low but as the trend continued I've I have felt that we should at this point almost take like worst case scenario that the projection should be worst case scenario and very um conservative and

139then if we end up overestimating that's easy to to dial back but um I know obviously it's there's it's a very difficult task to project something in the future but I do think that at this point and if not even sooner we really need to take a very conservative approach to these numbers and so if you could speak to that after that and then trustee Chavez what Dr Bauer okay thank you thank you I mentioned to see Chavez yesterday that we were using our demographic study that is off right but we as a district needed to continue uh using those numbers because that's the those are the numbers that that we have in terms of a study the Bay Area has experienced an accelerated Exodus of people uh you know we're not the only ones

140all the districts so um we are gonna need to have a new demographic study I'm not sure how accurate it would be especially after coping 19 right so um that is the answer you asked me ask me where are these numbers coming from and why are they off and I agree with you trust me I know they've been off but that is where they are coming from so we need another demographic study absolutely and that's that's what that's what this is all about trusty Quintero oh that's where I was gonna go that um the numbers can't just come out of uh a nice guess or something they have to come out of this very very fancy report that was provided to us by a firm that provides the numbers so um that's why it's based

141on that and also I'd like to remind us that when we just said okay well let's just shoot for 800 and if we don't fall off that then we're in good shape it probably works for you know um if you're budgeting for yourself as an individual but but these decisions that we're going to be making are going to impact people's lives and so if in fact the uh numbers don't come as high as we had projected we just wound up making a bunch of cuts how to fire all kinds of people people that you can't easily just get back all based on assumptions that were not true and imagine the response that we get from the community when you're tripling up kids in classrooms you don't have enough teachers that you wound up letting go

142because you wanted to just say let's just go hire him see where landlord so I've not intended to throw it back at anybody but the reality is that we is a word in Spanish for budgets you're presupposing and you have to walk this fine line of what is it I'd rather go have to make these tough decisions after the fact when you know what the numbers were higher but you know we didn't put people out unnecessarily um and uh and so it's it's that fine line of of trying to guess Madden use that magic that uh crystal ball and see what how many kids are in fact not gonna be here how uh how many are going to um are in fact gonna show up so that sort of point the point I'm trying to

143make is that it's a very difficult task and I'd rather fall on the side of not just really nearly letting people go unnecessarily when the numbers don't come out as bad as they as we and we had uh not I also like to uh mention that uh there are there have been efforts at the districts undertaken uh to go ahead and stem the loss of of our of our students to Charters and in certain instances they actually panned out where strategic Partnerships that we had with organizations allowed us to go ahead and push back on one particular Charter that was growing and they stopped and we were able to no longer have them continue to remove our students from our Public Schools so um those efforts obviously need to continue you need to move need

144to move forward and we need to stop the bleeding but the idea was to not just simply let go of everybody if in fact we can go ahead and turn back the tide then we were going to need a good team of folks to be there to educate our students and so um I get it the number is is a um is large but it's something that we have to deal with and like I said I'd rather not I'd rather not um just simply let go of folks and then after the fact say oh in fact we actually the number the number the last the decline enrollment wasn't as bad um the questions been asked over and over again you know where did this come from where did this come from part of it and

145you're looking at the last few years was the help the the years of hell that Alum Rock lived through and I apologize if anybody's offended but that's the only way of describing the last several years that we went through that took away the attention from everybody at the district to solely focus on the response to this hell um that was like that was in large part due to the decision of certain members of this board some who just called in earlier uh former colleague of uh of mine uh Karen Martinez who voted for a non-existent contract that didn't exist um individual in question just was arrested in Southern California yesterday and for going around and providing contributions illegally to people um and so my colleague here Marcus was one of the people that refused to

146end that contract and so for my colleague to sit there was Marcus and say what happened and where did this come from and not really take responsibility for the hell that Alan Rock lived through the last several years that led to loss of trust from the community is really really disingenuous and um you need to you need to take up responsibility and you know it's more concerning is the fact that the gentleman was arrested for contributions we censored our colleague uh earlier this year for the fppc findings related to her so so trusty Chavez and then immediately to trustee Marquez after that thank you if the numbers are off they're off and um and why would you want to be inaccurate and how long do we go in the wrong direction um doing the same

147thing the same way then if you don't want to use the 200 number I mean the 200 numbers and plus is not accurate so we I believe should use the historical numbers uh and and not what is used today we should apply the facts and the facts are it's 400 something students that we lose every single year that way our budget will be more on point thank you thank you okay trustee Marquez I'm learning to address what my colleague was was commenting and I'm hoping everybody that is listening out there I know you have a perspective of trusty quindero but first of all the hell that we were going through was created by Him and some of the community members that started calling all of these agencies that came out here and investigated and had

148us under the microscope because what did they find that the business department never had a CBO for I don't know how long that the budget had never been con um uh reconciled so we didn't even know what kind of money we were spending we were just spending and spending and you were just giving the superintendent every recommendation she wanted and we honestly didn't even know what the budget was everybody understands reconciling a check so you know how much you're going to be spending in your home well figure out on a hundred million dollar budget that had not been reconciled and at least two to three or four years we don't know how many was then there was this I don't know how many bank accounts and I asked twice three times for a forensic investigation

149an audit so that we can find out where the forensic got it Page by Page expenditure by expenditure what happened because we were doing fine before the last four or five years now so know that I I was dinged yes I was ding but it had nothing to do with anything that you said anything because you voted because Andre asked him to voted for the deltera Andres Quintero pulled me aside and said that's the company that I think is going to be good for us good for us okay okay yeah he was all I was all so I I you're trying to picture or paint this this this thing that that it was just the hell we were going through no it was the hell that was being created by all of these issues that

150the figment set and it said at the time fire the lawyer the lawyer at the time who had made that daltera contract was you you got a three vote there was three of you you guys brought him back after they set fire no speak to facts speak the truth because it's all in the figment report but it was all this chaos that you because you stood up and you said and I said you called the fppc are you accusing me and I said yes and you just pounded your chest and said yeah that's right I did I I'll take it uh you know I'll take credit for that so you brought all this chaos to Alum Rock School District and it has continued declining since you've been on the board giving the vote to expenditure

151and expenditure uh-huh we were told sixty thousand dollars for a superintendent office that was fixed after the libraries were all closing libraries was gone that expenditure in that and and that fixture never should have why because all the other districts have wonderful things and wonderful places that's what you said and then you come to the east side and there's and now all this not this all Antiquated places it looks all bad it looks and now it looks great no we should have never spent that kind of money with a slap on the CSEA members of doing that kind of expenditure from the general budget and I can go on and on and on Andres and I will take you on one on one or I will go out and anybody wants to know anymore they're

152welcome to call me because I will tell you I will tell them what the truth is you are part of the problem the solution you young man cost us the assembly seat you ran for the assembly seat on the last minute when a Latino could have held that seat but you threw your name is split the vote with Latinos you cost us that seat I am so upset thank you thank you this sounds more rude to me actually but uh at your request um trustee Marquez I'll ask are you done thank you very much I am done okay thank you um I just would like to say a quick word that obviously you know there's been a history that we all know about here you can't take away from that it has impact on going

153forward and all of those things and I'm not here to minimize comments from either of my colleagues because they were here prior to me on this board and and you know they have something to say about their time there I just would I think in some way focus on the issue at hand which is and you know as long as the conversation is centered in that direction I think we're on the right track but I'm just mindful of us and I'm not going to say anything you know I just at this point I would just like to ask my colleagues let's refocus because our you know our our kids sitting in those desks or in front of their Zoom classrooms or whatever don't care about this stuff I know it's important but the things that

154are important going forward is what I want us to hopefully um get back to so um trustee Quintero I know you had your hand up no it's sad it's sad because Marquez goes into this entire dire tribe every time anybody calls her on what she's done and the fact of the matters the community needs to know I I promise you that I will allow you the opportunity to respond but it in all fairness if we're gonna continue down this path tonight which isn't I think unfortunate but if we're going to continue it you know we need to allow each other to speak and speak strongly in your time but we can't and would you respect Mr President didn't you say we have to focus and just move forward you're allowing him to take this conversation

155I was recognizing now yeah yeah [Music] there's nothing I can do I don't have the ability if it's for something that we're moving forward on this issue right here with this budget so at this point I'm gonna this one I'm gonna go ahead and do um and that's I mean I don't like to do this but um Mr Ruiz do I have within my authority the ability to move this item forward or or is it yes you do yeah yeah president she just took over the entire thing and did not allow us to speak and and is big and so uh president Milano you'd recognize me so I'm gonna go ahead and move forward no several allegations and accusations they're a political attack and so um the fact of the matter is I failed you

156look the fact of the matter is that right it is you if you can move forward with this agenda hello is there anything I can or anything I can file a recognized member to have the floor and speak in this format that we're using here with zoom other other than asking for cooperation of the other board members you could probably direct the moderator to mute everybody else that you have recognized okay just in in order to um for this particular topic only just so we can continue to have um meaningful dialogue and not talk over each other uh Mr Gill can you mute the mic all of everyone's mics um accept unfortunately but myself just for purposes of facilitating this and the person who is recognized if you have something that if you would like

157to be recognized please oh but trustee Marcus does not have the ability to um let us know I'm just going to do this this is a very difficult position trustee Marquez and everybody I'm I'm I'm actually pleading with everyone to be respectful of the person who has the floor and I will make give my word and promise that when I give you the floor that I will have I will have the same respect and um discretion with your turn as well I have recognized trustee Quintero at this point and I understand that you people have comments but please respect the the protocol of and Robert's rules in terms of how we're running this meeting um then then president go ahead and do you want to recognize him but give him the boundaries comment make your

158comments only if it's directed to the issue that we are telling here the budget and just don't take it back on one of your colleagues all right thank you uh president so a lot of allegations were made in accusations against me um and I am proud of the fact that I stood by uh Law and Order and the fact is that uh well There She Goes Again Mr Gill I I hate to do this but because of the format that I cannot see trusty Marquez right now I I I'm gonna request you to mute her mic during only during the time when trusty Quintero is speaking because no way you do that and you think my right away I will come down on you legally do you understand you understand that you are there to

159facilitate not to take my rights away mystery release is this something that I can do in order to facilitate this meeting and share the media again speaking trust speaking Federal can you mute the mic for trustee Marquez and I will also say in In fairness that it is reciprocated when trustee Marquez is speaking even though I don't I haven't seen this to be a need but just in the terms of reciprocity can you also mute trustee confero when trustee Marcus is speaking just trying to be even-handed and fair with that it's not I'm just trying to facilitate this conversation thank you everyone for hopefully understanding and thank you Mr Gill so trustee Quintero you have the floor thank you so um you know as I was mentioned Joseph was attempting to to speak uh there

160was it was in regards to um the accusations that were made that I voted for deltera the fact of the matter is in 2016 four members of the board voted for Delta was not one of them it was a blank contract that didn't exist and that was that what I was referring to the dysfunction the problems that were existing at that time and uh it's very very flabbergasting and very concerning that our colleague is concerned about the cooperation with law enforcement regarding the investigation that took place with the individuals in question of that firm um we see an arrest that took place involving contributions or our colleague was uh digged for a five thousand dollar questionable contribution to this day we don't know where it came from or what happened to it and so I

161think their valid points about the stability of the district that I was Raising and so with that I just wanted to go ahead and clarify to the community that I was not one of the four Martinez Marquez uh Tron and um and Atlanta were the ones who voted for that contract not once but twice they would for it even though it wasn't existence the first time once they came back and it is still questionable they still moved ahead at the explicit uh record uh when the these when the administration had recommended not to move forward with it and so those are all things that the community needs to aware of because there's a lot of accusations that were flying up there throwing around and um and so even when we tried to clean this up

162and say part ways After All This Disaster or colonicas and uh her allies were the ones who kept on continue to move forward in that direction of maintaining the status quo that led to a lot of dysfunction a lot of problems in our district and so just want to make sure to clarify that for the community because a lot of a lot of accusations are thrown thank you for the time thank you um just before we move ahead release um do I also have within my purview the ability to put a cap on this particular item or um to my colleagues indeed can we continue to talk about this into the night basically uh well I don't believe you have a motion yet on the on the adoption of the budget but um approval or

163adoption okay can you continue I'm sorry Mr Luis can you finish every board member so far has had an opportunity to speak so as the you know as the chair of the meeting you have the right to cut off uh public comment once you have a motion but um what about um okay um so I I believe I saw trustee Chavez or maybe it was did you have any questions or comments we can go to um approval point a second okay so there's a motion a second um because I can't see trustee Marquez do you have um something that you want to say before we move to public comment am I am I unmuted yes and after Mr gilkin just as I mentioned can you please um for purposes of being even-handed Mr Quintero trusty

164quintero's microphone please thank you is he muted yes he is so trustee Mark is if you have comments one more comment because I am going to say that um in the interest of moving the meeting forward and remain trying to remain productive that we go until 8 15 on this item before we call for public comment um so that gives us about 10 more minutes for anyone else who has comment so go ahead um trustee Marcus first of all I would like to rebuttal what he said because I have I have completely been opened and Cooperative with all the investigations that were going that were going on always I don't know where he's coming off saying that I'm not I don't know if he's getting information that none of us got information which is very

165likely between you know between the superintendent and and the and the agencies that were coming in here they're all very tight all very tight-knit because things we did instead in closed sessions were getting out to the media the Mercury News the community people community organizations they were hearing what was coming out of closed session he knows it because he was one of them I'm sure he was because there were things that I said to him or an action he did and it all came out in in the paper and he knows this he knows this very well and the other part to that is that he's saying I I got he's accusing me or insinuating that I got five thousand dollars I'm sorry the five thousand dollars I got was from my account I loaned

166myself people loan themselves money they loan themselves is that something new to him or he doesn't know about that because he doesn't loan himself money but hey I've loaned myself money to my to my campaigns and he chooses not to accept that but instead make it sound like I got it from somebody well I didn't I got it from my family I got it was my loans and they're all recorded So he he is a liar since he's been on the board it has been chaos I have tried to work with him I really have tried but he's like a child he continues to fly off to make himself look good to make me look bad so that so that I don't get reelected but you know what he can say all he wants because

167my constituents that know me have known me for 30 years or more because they knew I have been working Ellen Rock for many many years and and I did not just move into this District I did not just come in five years ago I had my kids and grandkids through these School District which some of you guys don't and I and because I believe in this institution of public education I truly do and I did not move in two years ago or five years ago just so that I can get on the board no I have been here and I have paid the dues and worked in the community and worked with the community that know me so Andres Quintero you are a liar thank you as per your request are you done yes thank

168you I am done um so at this point I will um have I'm gonna go ahead and call for a public comment um on this item um I know do we have any hands raised or emails I'm assuming we do how many do we have if you have an estimate you're I think you're muted Mr Gill there we go so I have five hand raised I'm waiting for Mr Sanchez I just told you Mr Sanchez there's no bunch of there's no uh there's no comments um okay so um excuse me so I'm gonna I know that there was one that wanted to comment which was trustee uh Marcus um can you can you unmute her she's not muted she said she was done oh I'm sorry yes no your hand up I I did I

169I did I mean I did speak did you get to hear to get to him or did they you heard it trustee Chavez I'm sorry did I say Karen Martinez or did I say trusty Marquez you said trusting Mark as I thought I I apologize I meant to say it's because on my screen her hers is on top I meant to say decision and I wasn't called on so I'm just letting you know okay so I am um I know I mentioned earlier tonight um that I that I was only going to in the interest of consistency throughout the meeting have one minute of public comment but it looks like we don't have a lot of public comment at this time on this item so I'm still gonna um keep to our 20-minute board policy

170limit on this for public comment but I'm going to extend um if with no objections from my colleagues I'm going to extend to two minutes um their standard two minutes for public comment um just because there's not many comment or people with comment is there any objection from objection from my colleagues I need to ask you something uh do you have an objection to the to them no I I just need to just need to say that I my phone is blowing up right now and it's saying that there is something written and put up on there that I did not tell the fppc where she received the money is that correct is that quintero's picture that she put up because he couldn't speak I do not see that but I I believe there was

171something up there previously yes and you did not object to that correct on both excuse me yeah he did put that message up and it's true she did not disclose that information so given this format I did not to answer your question trusty Marcus I did not object um because if we were sitting in the boardroom the reason why I actually did not say anything because in the moment I had to think it through and if we were sitting in the boardroom I would not be able to prevent any of you from doing that same action so I interpret this format as being the same thing I can't prevent you from holding something up just as you would in the boardroom I had to make that decision in a split second and that's how I

172came to oh we're not in the boardroom president you are in cahoots with them because you're through a solitary vote for the superintendent and you allow him to do this you know you should have said you should have immediately said you need to put that off but are you done because that's traditional letting him additionally speak up okay well um again thank you for that feedback as I mentioned earlier in this meeting you have the opportunity to be on the same platform and you know if we need to have a discussion about how we behave as a board using this format we can certainly um put that as part of our discussion but um you should have that discussion with him because as sneaky as he is like this I'm gonna go ahead and um

173call for the public comment at this time uh Mr Gill so as I mentioned we have two minutes if we can get the clock ready please and we will begin at we'll call it 8 15 so we'll go with to a maximum of 8 35 and two minutes per comment um so Mr comments in regards to what to item two um what is it two zero three three zero one three zero one foreign there is a motion and a second on the floor so after public directly after public comment my intention is to call for a roll call vote on approval of the budget or the district's proposed 2021 on budget so do we have someone lined up Mr Gill yes we do and now we have eight participants first is Veronica okay Veronica when

174you're unmuted your two minutes will begin once you begin hello everyone my name is Veronica again um I don't know I don't know what to say I don't know if I'm embarrassed really or I'm very sad that you represent my children that you represent my funds to put those opportunities in my children you need to stop playing with our children's future it is this war won't listen to the parents student and Community step aside I refuse you to play with my children's future and opportunities they are children of color with disabilities already vulnerable to oppression and you're playing God with their education and opportunities different police stand with the community no rest no peace until we defund the police and invest in our kids and then again you know your children are leaving my children

175as somebody else said if you're not you're not making decisions I'm I'm tired and if you're not making decisions my family and my children we're leaving out of here so if you're losing 400 they're 402 add to that because I'm going to go to a district that will listen to me that will stand with my children and provide their opportunities because I do not tolerate this kind of behavior you do not tolerate this kind of behavior on our beers this is unacceptable okay we're not in what are you like five-year-olds that we have to have a mediator now I don't think so right and then again I'm going to say this one more time if you are not standing with us if you're not standing with Community then step aside and if you can't do

176that then guess what count count the families are going to leave your District because we will and we will organize with somebody else that will listen to us that will put aside that will put in front our decisions and we'll put it in front our children our opportunity their opportunities for being children of color color because I know that I told her not worth money to you and those five thousand dollars whoever is it's pocketing them guess what you won't have them thank you for your comment Veronica next person Mr Gill Lord Deleon okay Miss de Leon when you are unmuted and begin speaking your gns will start yes I just same thing as I don't I'm not gonna repeat but Veronica say and trustee markets every time we have the same topic about budget

177you always come and say I don't know where is this coming from from we see started Living we see people in this place and we know that we're losing charter schools to cover Alan black school district you're being here three terms and that that's why parents were advocated to have a policy to put a limit for the board members to use this space as a platform for politics please stop and you miss uh drastic Chavez too you need to learn you guys need to come prepared to the board do your homework and if you guys gonna be debating and this and that we all know the history of Alum Rock let's focus on the budget let's go back to the topic budget budget cuts Cuts Cuts we all hear that thoughts are coming so I

178just want to say that the parents we're going to be very Vigilant on where we're going to want to make those cups and I want to hear solutions from the board I don't want to hear you to clean your name with the mess that was done in the past us I want you to give me Solutions give me Solutions what are you as a board member gonna do to make sure we get uh the best for our kids education parents we are going to be advocating for our kids education and we're going to be making sure that the funds that the cuts don't affect the inside the classrooms and look for other resources grants go to Google go to the tech companies bring Solutions bring money to the schools that's what we need we don't

179need politicians and I ask you please resign both of you resign and and Trust the uh president you're also throwing not a good leadership so Karina I read a step forward be a president and have control of this board because I'm tired of being here for even at 2 am I being here listening to you guys and I cannot even and you only give me one minute to speak you only want giving me one man to speak naming yourself limit yourself it's time to limit yourself and don't and don't talk over me and when people have fully comment is the public comment you shouldn't be talking thank you trustee I mean thank you Miss de Leon um trustees please during the public comment if you have a clarifying question or comment please wait until after

180the comment um Mr Gill who is the next person up Amanda zendejos good evening oh go ahead this is really embarrassing it's very very embarrassing to see that you can limit us you can call us out you can put the meeting on a break when we're out of order you can even you've even said this has even been said to call the police if continues of disruptions but this is going on between you guys you put a cap on 30 minutes for our public comments and this is back and forth how much time have we lost already well I'm gonna I'm gonna give a comment on the budget I see that classified will take a big hit again these are the front liners the backbone of our district I've never seen any of you guys

181speak up for us classified employees here it is really sad that you believe that we're that disposable but let me tell you these kids the first interaction is with classified the connections are also done with classify and most of these kids come running to classified workers when there is problems or mental breakdowns we are the ones that they run to and Trust to cut again on classifying and for you guys to go ahead and give races to admins to soup knowing that we were at a deficit you should all be ashamed all of you board members who voted on this you went ahead and gave them a raise and then now you want to cut on our classified employees this is not okay and it's not going to be tolerated anymore and I'm gonna make

182sure everybody knows because I'm gonna post this in every platform so they can see how embarrassing our board meetings are I'm truly disappointed and I want transparency and I want all this information sent to my email about how we got in a deficit I do want to know I'm going to study it because I don't want these mistakes to keep on happening it should never happen because this is my kids education put on stake and like everybody else said do you want me to leave with my two kids thank you next comment Mr Gill this is Olivia Ortiz when you are unmuted it begins yes hello I am speechless I am special is what I've heard tonight all all the crap that is going on right now I was hoping that I was going to

183be over I worked so hard to change this board so we can move forward and this is not happening I put that on you president you are in charge you are the president you are supposed to put order on our board you have you have the right to do that why why you guys have the privilege of you guys going back and forth right I mean you took my right to speak to speak earlier on the past item you took the right away from me as a parent I was gonna speak on behalf of my kids education and you took the right away from me you took it you guys took that because you didn't let me speak and you guys are going back and forth back and forth about personal attacks we know what

184happened we know what's going on we know and you have Dr please Dr uh president do you work put some order in this it's a shame I'm so it's an embarrassment that you guys are acting like that and you're letting that happen it's embarrassing we need to speak about our kids we're talking about a deficit for millions and millions of dollars and you guys are speaking about each other and and then blaming each other let's move forward it is your job it is your job to find out and to fix this and I am very very worried that some trust is asking how do we get here why do we have this efficy when it is your job to to know to know the deficit why do we missing money why is the money this

185is your job as a trustees shame on you shame on you and I really hope that you guys do cancel the contract with the police because like I said you're gonna lose You're Gonna Lose enrollment and we're getting bigger and a bigger trouble so please do the right thing until the next comment Karen Martinez good evening again um as a former Trustee of this board I continue to be embarrassed um it's unfortunate but I do live in this community and I will always live in this community and I will not be pushed out I will continue to advocate for our community as I did while I was on the board I think we really need to focus on the figuring out on the a day there was a report that was given to the board

186that completely showed what was happening and it said I remember it clearly is that people were not having children as early as they once were it was already fourth we were already told prior in advance that our Ada was going to be going down we need to be using the numbers that historically within our district that we have been seeing Ada go down that needs to be addressed and using each other as scapegoats is just so how we are adults governing over children to ensure that their education better and this is appalling that this continues you know there is governing board guidance and and education that each and every one of us as trustees and elected officials should take and I have to say that in Evergreen and San Jose City school board meetings for

187the community college is not ran in this way um and so I want us to stay focused and not try um to throw one another the butt under the bus because at the end of the day our job was to support and help what the superintendent was asking us to do she's the only hire in Fire and so with the revolving doors of cbo's and Caldera working as hard as he has to work to correct this I think we need to be asking the superintendent of where the budget has gone and what have we done to rectify it and how we're going to work to do that and I think it's appalling trustee Quintero that you try to use me as a ploy thank you thank you Mr Gill next comment it's Maria Martinez hey

188Miss Martinez when you begin speaking and your microphone is unmuted your two minutes will begin thank you trustee uh I'm here like a parent participate in my parents um and yes I want to say thank you trustee market for being so Boko and asking all those questions and they buy it but that wolf has been years ago when is were there since they made many decisions that affect the education by it or children and I never saw her you defending and questioning when when them is in the in the war and we also lie asking you as you are represent or kiss you will connect through video conference by soon and hopefully that is to give it to a laptop ready for you just click and you can and we can see you and also

189I want to ask you Thursday Quintero I want to see your face because I see only you you had and I don't see your face I know that your background is wonderful it's beautiful but I want to see you face um uh as your trustees and and like the pattern they say that's enough please focus on the budget please ask uh searching solution please stop to be in the in the meaning like that you're always asking to the parent that be quiet and don't clap in the club in the in the board meeting but to be able oh my God it's a terrible terrible place thank you next comment Victor Vasquez Minister Vasquez when your microphone is unmuted and You Begin speaking your two minutes will begin hello um I just want to remind ourselves

190that the budget is a reflection of our values it's a working document it reflects what we're going to invest in our students and I think that you know we talked about different reasons why we're at a point that we're in and definitely displacement and what we're seeing in our community it's one of the the larger issues that's impacting us and I hope that you know I want to take that as an opportunity that if we want to increase this budget we have to protect our families we got to Pro get involved and also advocating for affordable housing advocating for the renters rights advocating for those things that they need so they can stay in our neighborhoods or around our neighborhoods and also so they could also have a safe place for them to sleep learn

191and that also will help you out in terms of your budget in the long run the other thing I feel like it's a larger problem that's reflected in the budget is the structural issues that we know exist in education and how it's being funded a few months ago you passed the resolution supporting schools and communities first I want to continue to invite you to walk with us talk with us educate community members about why that's needed as a solution to also bring additional resources for schools that we that we need and lastly I think that the Hellcat to me is very important uh to a lot of parents it is because it provides additional funds there's just a report that came out by public Advocates that mentioned that 56 school districts misused their lcat by

192providing funding to law enforcement uh harsh punishment rather than supporting English Learners and those students are colors they're supposed to to support so in echoing I want us to also be mindful of those things that it's not just something that we can do whatever we want with this budget but it's supposed to support our students and once again we ask you to like defund antly thank you uh next comment Mr Gill thank you and just as a reminder we have five more minutes for this public comment Oscar Sandoval hello um hello uh first and foremost this is one of the most embarrassing board meetings I've ever attended virtually or in person I heard rumors about how this district and how this board operates within years past but I almost was skeptical and they were confirmed

193this evening um I really like I really like how you accidentally called one of the parents a trustee earlier president because honestly those parents should be in those trustees seats right now right now to make decisions about the money in their district and the folks sitting in those seats and I don't know if you can feel it but there is a Revolution Brewing in the streets everywhere and especially in Alum Rock have you heard the conviction in families voices change is coming whether you like it and as Victor mentioned a few minutes early you can choose to walk with us or you will drown in this way that is going to overtake you up there is change coming to this district and I just really hope that you're able to take a moment to step

194back because I'm a middle school educator and honestly my middle schoolers would be appalled at the way you've been treating each other and the way you've been operating when they're hundreds of thousands of dollars at stake here and there are the future there are people's lives at stake um people's futures at stake and when you ask yourselves why are people leaving the Alum Rock District they can literally just watch this meeting and this will give you one of the biggest reasons for why people are leaving this District I would never enroll any of my future children in this District if this is how um the trustees act um the budget and other crucially important services but to go back to the budget I'm calling on us again to make sure we cut those contracts with

195San Jose police and the fact that you are cutting salaries are you cutting funding for some of the most important employees while boosting and getting raised to other people is appalling in fact I think what's been happening in this meeting and these budget decisions could be potentially be a human rights violation is disgusting and honestly if any of our youth decided to walk out I hope they do I hope our youth potentially about what's happening right now um because this is a travesty and honestly these kids are losing every moment they have you as a board uh thank you thank you next comment Mr Gill Za Gonzalez Ms Gonzalez once you are unmuted and begin speaking you're two minutes hello uh board members I'm here as a parent and I want to make that really

196clear I am shocked to see that this is something that is continuing um I just have three comments the first one is to use um president you appointed yourself in that seat obviously because you thought that you were gonna be able to do a good job this is a really good example that you're not doing it you need to control the board you need to be able to to shape it and take it in a way that is going to benefit our kids second fighting when we have really important subjects to talk about which is that budget which is the money of our kids which is the money that we're gonna utilize and to see each other fighting like that instead of focusing on what really matters it's a real example that none of you

197guys that were in the in that fight they start to be in there please make us a favor and get out of those seats and let people that really want to talk about our kids that really want to bring and and be and spend the money in the correct way to take those things because it's obviously you guys don't care about our kids anymore and thirdly yes you guys are doing that we have in our schools and that our kids see daily nobody needs to already do that defund the police make sure our kids get what they deserve get make sure our teachers and our parent Educators and our custodians is staying their job doing their job for our children because that's where the money needs to be directed at research Justice programs and personal

198that are really there to help our children not cops that are there to make that prison to school blind and make more money and they have our kids when they're getting incarcerated thank you have a good night thank you okay so um um that that was the the 20 minutes of public comment that we had said so at this time I'm going to call for a roll call vote to approve the adoption of the district's proposed budget uh Dr Bauer I just want to be here but this has been a very inaccurate statement mentioned by several of the speakers nobody's getting racist in this budget the only ones who have tentatively agreed at this moment is Teamsters so I just want to be very clear that you're not voting on especially administrator races so I

199don't know where that came from but that is inaccurate and I want to be very clear that the community understands that we are still in negotiations with teachers we're still in negotiations with CSEA and that's where we are thank you okay thank you so I will call your name for the vote on item 3.01 to approve the adoption of the district's proposed budget as I see you on my screen trustee Chavez proof um I'm sorry I should speak up more um even though I I don't feel that it's an accurate number I want to support the administration and I want us to move forward and hopefully be more respectful of each other so I'm I'm going to back up this vote yes thank you okay thank you trustee Marquez um I will not be supporting

200this budget because I have way too many questions and way too many concerns on how the expenditures have been done and how it got us here and I just um I am not confident that this Administration can can get us out of here because by 23 22 23 we're looking at more Millions more and I by that time we'll probably be bankruption correct yeah that will be a no vote I also would want at this point we're taking that we're taking the vote okay and I would like I still need to vote I'm sorry so sorry so I vote I as well so the motion passes four to one with trustee Marquez um voting no on the item so now we will move forward to item back to item is this 7.05 no compared to

201the regular agenda for president and its public member this is the no we were we weren't done with 705 we were going to come back I'm sorry I think is that that's correct right okay so item 7.05 we're returning now um to the board will discuss and review the marriage to school resource officers um other questions or comments from my colleagues foreign I think I saw something from your did you have a question or comment no I did I didn't hear what you said you broke off oh I'm sorry we're we're to the portion of the agenda back to 705 where we are on board member questions and comments on that information only item and I apologize I didn't see the order of anyone else that wanted to speak so I'll just say as I

202see you on my screen so trusty Chavez thank you and I will go ahead and let's do it then I will go ahead and speak to this trusted uh president okay you'll be after trustee I thought you would call me to make a comments you have the floor okay sorry excuse me um like I said before I'm only gonna say it one more time can we please put the item on next month's agenda item for a vote thing thank you trustee Quintero is the is it clear what I or do I need to clarify more is it clear or do I have to clarify it again um Mr Rogelio can you advise me please all right I'm sorry in terms of getting the item on the agenda yes is there certain language that I should

203be saying in order to request this to come back to the board next month the sros s I'm sorry you're cutting you're cutting apologize I can hear you I'll go ahead trustee I mean the the best way is just to send an email to the board president and to the superintendent with the agenda item and with the preferred agenda language and and make sure that you say that you state that you want it on the next agenda and you want it for action and that you submit that a week before the next scheduled board meeting thank you very much Mr Rogelio thank you president Quintero um hey I just want to thank everyone who came out and spoke on this issue and those folks who've raised the concerns it's always however you tell Gage and

204uh in a healthy Democratic process of having people uh Express their concerns or voice and so looking forward to seeing the item come on next uh next month and then we can go ahead and move uh take action on on the item uh the concerns that were raised about um making sure that it never happens again unless we pass state law that prohibits sros on campus you know those those actions can be done on a year-to-year basis or when you have a new board and so just want to make sure that folks are aware that uh even though Alan Rock School Board takes action once and uh in two three four years another board may take a different action and so just one uh just to address some of the concerns that were raised by

205the con by the speakers but thank you for stepping up and speaking and raising uh the concerns here at a local level I know that there's a lot of uh a lot of there are many things taking place at the national level and so they're providing an opportunity for us to deal with these historical inequities and systems of Oppression that have that have lasted for too too long and so thank you all for uh stepping up yeah just uh I want to clarify with Dr Bauer um clarify that start on March 12th when uh we went into shelter in place I'm assuming we have not paid any police officers since March 13. okay just wanted to clarify so defended as of now um and then uh next month we'll be discussing this item more um

206and just you know want to again reiterate you know unfortunately our community has suffered has suffered from the past and so just you know I'm glad that our community um our trustees you know seem to remember a lot of things so that we um and so thank you community for coming together thank you community for speaking up on behalf of our children um we look forward to continuing to walk with you all in truth um for the best outcomes for all of our children children okay thank you Tres D Marquez whom I needed no and I unmute it you're unmuted and you have the floor thank you so when I had my one-on-one with this with superintendent Bauer um she told me the same thing she just said right now that we have not paid

207on this contract since March and she's just been pointing it to March 13 that we still owe on this contract that we have not finished it and I believe the hedano has just said that this is a contract they're gonna it's gonna end in five days so tonight she told me that tonight was for discussion and because um the president had put it down for discussion when the when the community had asked for it to be on an action item but I said that that doesn't make any sense if we're not paying on this contract um and we don't have money for next year are you bringing it forward and she says no because there's no money so she's not bringing it Forward which told me that they were gone they were going to be

208gone as of the in five days that they were going to be gone so I just wondered what this whole process of listening everybody talk about this um this item is that they're not going to be here but then I understand that they want this in writing that they aren't we are not going to be issuing um you know a contract to the sros that um I am I am definitely would not like to bring the police back given the nature of the entire nation of what has been happening with the deaths of our black and brown you you know people that are constantly being killed so I I mean I was very happy to hear that she was not going to bring it forward that it was already gone but it has become this

209you know this big thing and I don't know why people are are not saying that they they are they're supporting the people in our community that want Justice here and I I did not hear my colleague my colleagues I did not hear Andres Quintero speak to you know that he is there that he will not support it you know he will support you know the community people I did not hear that from Karina as well she's just thanking people and saying I'm gonna walk with you guys but this this I don't know that it's coming back for a vote or not when I I don't understand why people don't get it when they say to not bring in this contract back they're gone they're gone they're not they're not going to come back in five

210days are going to be gone and I thought that was a really good thing given the estate of the entire nation of how it's going with the police they they need we need to stop them we need to do something we need we need to secure our our families in our community so I am I I honestly I'm confused if you're bringing it back for a vote um I mean you already know that I I support the community that brought it to our attention I was happy to hear all including all of those um instructors that are in the city college and and Evergreen you know that you know that came out with their students in support of help us you know vote this you know to defund them um but we can't we can't

211defund them because we don't have funds to defund them and it's already not going to happen so that's where I stand on this item and like it comes back then fine I will vote you know for us not to do this no more until but I am concerned that we need to put something in place so for those of you who are advocating to defund them then think of how we're going to replace and who we're going to put in place to help our students and and I I for one I want to start there with counselors okay thank you as per your request um trustee Marquez are you there I am done yes I am done thank you so I'm gonna um make a few comments and then I saw trusted and then trustee

212Chavez after that um Mr Mr Ruiz am I I'm allowed to share my screen to provide some um supplementary information to my comments like not technically but if I were in The Boardroom would I be allowed to present information on a on a screen or provide information to the public publicly so this is a first so I would say that the answer is yes um because it's being made available to the entire public so okay yes so if I do I have the ability to share my screen aptar all right he says yes with the thumbs up okay um okay and so I I am going to take a moment to um to take some to make some comments on this and I want to um address first of all I understand people saying that

213you know there's the limit for public comment and not and not for the board and particularly me I'll have I'll take that from people who have said that but I do want to provide a reason why when I ran for this position I did it with the with one of my premises being transparency and when I come to make a decision I want the community to know why I'm making that decision and unlike the public who has the ability during the month to have dialogue and make comment and post and many things like that unfortunately or fortunately due to the brown act my colleagues and I do not have that opportunity so our single opportunity to share information with each other and to be transparent with the public is during this time of discussion so

214if if I mean I know that's not going to sit well with some people and that's fine I respect that you know you can just step away for a moment or whatever but I do feel that in the interest of transparency and sharing information with my colleagues is that it's important for me to do this so um I I want to just make sure that we're clear at least from my perspective of of what we are talking about here and so if I can let's see select the the screen this is not so do you see the one that says what are we talking about is that the community okay so the you know the obviously we know what we're talking about here you know we're talking about this school resource officer so if I

215I start with the obligation that we all have as trustees the legal responsibility that we have so in a board policy 5144 um we we it states that staff shall use preventative measures and positive conflict resolution techniques whenever possible um and so I think that's very important and it does speak to a lot of what we hear from um the public comments that we get and things that we believe as board members ourselves we ourselves we want to use preventative measures we don't want to criminalize children or do things of that nature and so that's part of our board policy board policy 3515 states that the Board of Trustees is committed to providing the school environment that promotes the safety of students employees and visit visitors to school grounds so we do have the obligation

216whatever that looks like to ensure that our visitors our employees our students are all in a safe environment now people can go back and forth and have disagreements about whether sros fit that bill or anyone else but that is an obligation that we have as a Board of Trustees and finally the California Constitution states that all students and staff of primary elementary junior high and senior high schools have the inalienable right to attend campuses that are safe secure and peaceful so that's really what we're talking about and I I believe that whatever side you're on in this issue I think we have common ground there we want our students our employees everyone to be in a safe secure and peaceful environment so that being said during the you know as I mentioned we're not able

217to comment too much during the month as trustees but I did want to make some clarifications on some information that I had seen out there publicly and so so one of the things was that since 2011 2300 Latino students have been suspended by the school board um and this first off I don't believe that the school board is are the ones that are directly suspending these students I wanted to clarify that obviously we are in the role that we're in and have placed on part but that seemed a little um a little different than the reality there so if you look at 9 500 Latino students per year the average so any average year we have about 9 500 Latino students and if 2300 have been suspended during the course of those nine years that

218averages about 255 suspended Latino students per year obviously we don't want not one student suspended but I mean at this point that's what we're averaging 255 suspended Latinos per year so if we assume an average of 9 500 Latinos in the district 255 of them on average are suspended that's 2.7 percent of Latinos are suspended per year so that of I don't want to see two percent two point seven percent I want to see zero percent of any kid in an Ideal World um but when you see 2300 Latino students have been um suspended I just want the perspective that that's less than three percent of all the entire Latinos in the district which is still too much but that is the actual number and also one of the things that was out there was

219that um two schools in our district only suspended latino children that's certainly concerning to to Manny myself included but also the flip side of that if we're being um you know clear with data is that um 80 to 85 percent of the total population of those schools is Latino so it would stand to reason that there's a higher likelihood that latino children would be suspended am I saying that that justifies only latino children or anything no I'm just wanting to bring a little perspective to to that point is that when the majority of students are of any particular characteristic in a school then you may see an increased likelihood of any particular variable whether it's suspensions or straight A's or whatever um another thing that said that top the top five schools they mentioned what

220our top five schools were um and and those schools if you look at the data they have an average of about five percent suspension rates the state average suspension rate is three and a half so that is I I thank the community um and who you know people that are putting out this information for pointing that out because you know again any number is too much but if the state average is three and a half and um we're at five percent on our worst five schools and that's too much but again keep in mind those are the lowest five in that particular time period um and the thing that that if you dig a Little Deeper that to me is is a bit more of um you know concerning or wanting more investigation and looking

221into is those children who are suspended in the categories of defiance only or violence without injury and so you know that's when a kid is you know not paying attention or talking back or whatever it may be um to suspend a child for that I think those are perfect opportunities for the many services that we have available to them whether it's PBIS or restorative justice or counseling or whatever these to me are areas that that you know is is custom built for um so that's something that I would want to look more into the good news about that though is that suspensions for defiance only which is one of the ones I just mentioned are down 82 percent from last year it's so it's point one percent of our students have been suspended for defiance

222only so it's on the downward Trend but I still think that's an area that we can look at um overall District suspensions are down 38 from last year our average suspension rate is or our current suspension rate in the current year is 2.1 percent and as I mentioned the state suspension rate is three and a half so we're you know a full almost point and a half lower than the state suspension average rate again we don't want any but that's what the numbers show and during the past four years we have never actually been above the state um current state average of three and a half percent so suspensions we want to continue to look at them and address them but they're actually declining and they never have been in the past four years higher

223than the state average so with regards to the school-to-prison pipeline which is a big thing that I've I mean myself has always been concerned about um you know 20 30 years ago in school and up until this point um it's really a big part of it one of our speakers tonight spoke to um the the punitive nature um of of discipline sometimes and how that is to paraphrase that is one of the key factors that does lead to the prison school to prison Pipeline and the ACLU itself has stated that students that are funneled out of public schools in um and into the juvenile hall and criminal justice systems that is really the definition of the school-to-prison pipeline so fortunately for us during at least the past four years we have had zero expulsions in

224our district and there and by virtue of that we haven't had any SRO involvement in that in the past four years so the argument that the sros have been involved in the school to prison pipeline I know as a larger concept and nationally and in certain areas certainly it's it's a concern but at least what I'm looking at the data in our district locally doesn't seem to to support that in that way so there's we've heard different perspectives and some people are very strong and we hear the word community be staying with the community and there's obviously a you know a contingent of our community that does feel this way but this is there are more voices in our community and so one you know in the interest of confidentiality I haven't included any any

225names but there are community members that have publicly been saying that they're in agreement that we should have police in our schools many of our students make good connections with them their children are doing well because of those connections that those officers have protected them in the school environment and they're grateful for them other people have said that yes we should have police and they say why because we have the need for them we have a lot of need and I the statement that I find particularly interesting and relevant is that what is needed is diligence and better management and so with respect to how our students feel in the middle schools we've a couple months ago got this report back um based on surveys that our students filled out and the middle school students

226did say um number two on this list here that they need security sros and supervision to feel that their environment was safe and welcoming so that is direct feedback from our middle school students and their position and how they feel about sros uh Chief Eddie Garcia of the San Jose police department obviously everyone has their opinions about you know who they people are and what they do but specifically to sros and their role he has he stated in the mou officers doing the work of school administrators and enforcing school rules is a recipe for disaster and not the purpose of having law enforcement on campuses so the police department does not want to be in any way shape or form involved in the discipline of students on campus they don't don't see that as a

227role and they've in fact created mousse with other districts clearly stating that in black and white and if there are people who have who have had different experiences than the data that I'm presenting that that was available to me please let us know because you know if this is inaccurate then we should know about that the Journal of Criminal Justice with research did a this is a study from 2011 in the Journal of Criminal Justice and is the findings show that sros were not associated with an increase in total arrest such results are contrary to the criminalization hypothesis and may even signify that sros have a positive impact at schools now this this is data that I'm that I'm pulling I understand that other Studies have been alluded to in public common and I would

228love to see the references to those to weigh it against this but this is an article from the general criminal justice um and so I again what I find worthy of further investigation conversation is that bottom part in blue that school resource officers teachers principals and staff need to be mindful of the negative consequences associated with punitive disciplinary strategies and criminal arrest I don't think there's any um disagreement amongst board communities that we know that when where if we were to have a no zero a zero tolerance policy or we were punitively penalizing students and suspending them at a high rate which ours I already showed expelling them at a high rate which I showed then we would have um you know something to talk about there for sure so during the past several weeks

229I've met with an SRO officer high-level law enforcement staff our middle school principals I attempted to meet with some arusd parents to get some unfiltered feedback but I guess that there was a misunderstanding about our ability to listen to um parents in that form in that forum and teachers and trustees from neighboring districts and the themes that I came across and how all these discussions was that rarely in our district if ever where sros involved in any level of school discipline again if you've had a different experience than that please let us know because what I was told was that they're never or rarely involved in that the one instance that I did hear from a principal was that there was an incident where a child needed to be restate restrained because they were harming

230physically harming themselves they they were having a high level incident and they needed to be restrained to protect themselves from themselves scheduling and availability of the sros was inconsistent we've heard some of our communities speak to that in past meetings about a year ago that they they didn't know when they were there they weren't there they were on their phones so things like that that was a theme that came up um numerous instances of intervention with external threats so people coming onto campus people doing potentially dangerous things on campus during school or right after school and in those instances sros were able to intervene and protect our students and staff from those people coming off campus again though back to the availability sometimes the sros were not there when you know when they needed the

231scheduling wasn't working out that way and finally site administrators want sros to build relationships with the school Community the whole concept of community policing I know in this moment you know the whole um defund police is really the sentiment of many people but I I happen to think that you know there is an opportunity to look for common ground and and find opportunities that we can do things in the right way um so the reason why I bring all this up so um you know in the past few weeks there's these are some images that have been publicly put out there that you know in association with our district and obviously everyone has the right to express themselves and their opinions in any way that they want and I encourage that um and and I

232don't have any problem with that but these are images that have been put out there about with literally the title Allen my school districts or something along those lines so this is the image that goes out there there's comments made and these are by community members attached or not to Alum Rock District Community leaders there are elementary school children being criminalized on their school campuses when they should feel safe where they should feel safe and um I think I demonstrated if the data is correct that there do not appear to be children being criminalized criminalized on the school campuses the reason why I bring this up is because we're talking about bringing resources I love the comment about talk to Google talk to these tech companies bring us resources that's exactly what we should be

233doing that is 100 right that's what I want to do but when you know if the when the image of this district is coming across in a certain way and certainly we as trustees as you mentioned have not done anything to help ourselves in that way tonight and in past meetings as well um but a combination of imagery that may or may not be consistent with facts our own behaviors as board this is what the public sees about us this is what's put out these are headlines from the past 12 to 18 months the words that are used tumultuous months of scandals history of mismanagement embattled the district story dysfunction pretty bad again troubled Alum Rock story dysfunction as I just mentioned many of those labels are deserved but if they should be in my

234opinion those labels should be based on fact the way we behave tonight that should be you know that should be there but if there's imagery going out there that's not supported by the actual facts then the impact of that is that when I'm trying to go out or my colleagues and build Partnerships and build relationships it's that much more difficult when we continue to perpetuate this Alum Rock story and so just getting very close to the end here um school resource officer grant that we had was that we have until five more days is a hundred thousand dollars so we have that we pay for 22 student and family support programs we had in 2020 2019-2020 that includes PBIS um restorative justice counselors programs for parents um all those types of programs the budget for

235those things is 4 million three hundred forty six dollars or four million three hundred forty six thousand three hundred and eighty one dollars again this SRO Grant is a hundred thousand in addition to those 22 Services there are 18 additional Partnerships and services that we provide for family student and family support at no cost to the districts those are those Partnerships that we've we've been able to develop and provide in-kind contributions and and provide so a total of 40 different programs that we provide in everything that the community is asking for um Arts um counseling PBIS restorative justice all those programs the total and then if you include our Visual and Performing Arts because people have ask for funding for Arts that's roughly and I think it was this is actually a low estimate three

236million dollars to those programs and this is not including our Athletics programs so just including our um our our student services art and support programs and um versus sros the total budget for the support programs in green here is seven million three hundred and forty six thousand three hundred and eighty one dollars and the red line here is um school resource officers at a hundred thousand dollars and so a hundred thousand dollars is a hundred thousand dollars no doubt about it and we could do things with that money but again if you when we hear the comments that we hear and things that are put out publicly I just want to make sure that our public understands the true scale of where we are investing our efforts and and putting our money where our mouth

237is so I'm gonna um close it with this as again someone said that we need action we need you know some movement here we don't just need talk and so I hope to provide that in some some way um so one thing I'm going to request from the staff to bring us is is the feasibility of providing the board with an ongoing quarterly or semi-annual report the detailing suspensions and expulsions that is broken down by school race ethnicity grade level suspension or expulsion those categories of foster children homeless special ed English Learners and the reason for suspensioners expulsion so that we can begin tracking those numbers at the beginning of the school year and either quarterly or semi-annually review that and make adjustments as needed along the way the second thing that I'm going to

238be requesting and I'm hoping that I believe I'm able to do this is in light of and this speaks to trustee Marquez your point earlier which was very um had a lot of wisdom I think in light of non-avail non-available sros in the coming year I'm going to request for staff to set up a closed session meeting with law enforcement to review our tactical response plan which is if you know we have a serious injury or a serious incident on campus what is the plan to respond to that so I'm going to ask that we set that up and any vote that to approve a plan in that closed session meeting would be announced in Open Session following that meeting and that's outlining board policy zero four five zero and so um I know that

239was a bit long as I mentioned I thank everyone for listening to me I think to me just the important is that you know there's you can use data in any way that you choose obviously we all know that um but I want to I just want to provide the public with some other data points that according to what I've received in information are accurate and the last thing I'll say is that I do truly believe that there is Common Ground here um you know I'm not entrenched in any of my positions I'm I try to be willing to listen when given the opportunity um and I don't know if you'll see this or not but in my recommendations and things I try to incorporate What I Hear into the my opinions and the actions

240I bring forth so thank you everyone for listening I apologize for the link but tonight I felt that was important um I think I said trusted and then trustee Chavez prior to me speaking so I had a long speech speech it's meaning as we will be Chavez for calling this back um and I want to be more direct on that question and I have a question for Rogelio if you can mute yourself as I'm asking um can I bring a resolution to the board uh um can I bring a resolution or a board policy ensuring that no police will be hired in our district yes okay so yeah I mean we just got to do action we've got to move forward um so thank you for clarifying that okay trustee Chavez okay um so um

241president I want to thank you for all of that and and I also would like to request that they bring uh more statistics the pros and the cons that when the sros have been here because um we don't have bad kids we have really good kids we sometimes they just make bad choices that's it you know and sometimes they they're acting out as a cry for help and I've seen officers help children um I have not I mean I have seen officers abuse children and and um I have seen it with my own kids uh the two of them experienced it and more than once uh to the point that they had them on the ground eating in the dirt and also handcuffed them for three hours in the back of a hot car and

242it was 105 degrees that day so you can imagine all the windows closed with them in there but the sentiment here of a lot of the community is we need to get rid of them but like trustee Marcus said we need to replace them with something um and I think that we should have that conversation before we have a discussion on the sros the next time so if you can you know if we can have that first and then and then do the vote because I think we need all of this information because I want to thank all the sros because sometimes it's needed sometimes they behave badly and sometimes the parents once they get involved and see hey my kid is acting out I need to address this they are actually stepping in and

243stopping the the student from getting worse I I truly believe that because um it happened in with one of my kids um and they made a contract with my uh one of my sons and they were monitoring them and what was being done for them and they gave the attention that he needed and every single time they called him in um both of his parents were there which I guess kind of surprised them but our sros needed um I I know that because of safety they you know they voted before we voted before to extend their contract but now that I know more and I would like to get all of the opinions of everybody before we do make this vote but I do want to make sure that we do vote on it uh

244because sometimes the community feels like like we're not listening we have listened to them but if we don't agree with you it's not that we don't you know like you or we don't want to listen to you or that we didn't listen to you we did listen to you it's just on this particular item we voted this way and you know we need to get past that because we're all here to try and educate the kids and it's better that we don't um it's better that we work together and in respectful ways so that that way because the thing that's the most important is the education for the students and we have to remember that at all times even when we don't want to hear what another person has to say thank you trustee Chavez

245any other questions or comments on this item okay so thank you everyone for your participation and um understanding our move back and forth between items on this one um and with that being said we can move now to Let's see we did I am so to item 4.01 is that correct Mr President I see some hands raised oh we already took public comments okay so um we're moving on to item 4.01 we did we took Telecom yeah in the beginning and then we went to the budget and then we came back okay so item 4.01 um for is that we're on the correct item now Dr Bauer is that correct if I'm my notes are okay so request to address the board on um items that are not agendized tonight now if these hands are

246for this item certainly we can um take take those um requests to address the board um do we have so we do have hands stuck uh Mr Gill crazy yes only one hand okay so um we will have two minutes public comments same as I did with the other one two minute 20 minute um limit um and um do we have any emailed comments on this item 4.01 Mr Sanchez uh no none okay so um who was the the speaker that we have on this item Mr Gill so now we got three people first is Veronica okay uh Veronica you have two minutes when you um when you're unmuted you can be interesting and the clock will start um before I start what is the uh the 4.0 can you remind me the title of

247this item please yes 4.01 is for any items that are not agendized on tonight's agenda thank you so something that is not agenda's is your resignation I want your resignation uh uh Ernesto I do not feel my children are safe under your board if you believe to stand with the police then that is your call if you're not standing with community and with my children then you started with police and if you believe in the killing of black lives and children of color then that is you that is your born and that's what you're going to stand for okay that is exactly what you're standing for and then again I'm calling for your rest technician this is something that is not on the item so I want it to be an item right if it

248can be if not then trust me we'll get you um we'll make sure that you resign because my children will not be in in a in a place where they are not safe where you're pulling data how many Kill how many students did you actually interview how many students did they have other options besides choosing that right your data is also very manipulative if you haven't noticed as well and you coming to our public forum and acting as a board trustee and leaving our public comment so erratically and not acknowledging that we ask you to leave politely that was another thing right so again Ernesto we ask you for your resignation we ask you that you start putting yourself with if you're standing with the police then you're standing against black life matters you're standing

249against our children of color you hear me then so do not find a black lives matter memorandum today if you're not with against defunding the police and having zero police members in our campus and there is no Common Ground no whatsoever I will not tolerate my children being in a car in a hot car of a policeman and if you trust me whoever Chavez if you acknowledge sign you want your kids to be in a police car that's you not my children it will not happen to my children or my children's and then my community thank you next comment Mr Gill hello this is am I unmuted uh yes so once you start talking your two minutes will begin yes this is Amelia um and I was raising my hand to speak before but the

250public comment time rank on the item of student safety um I work with families in the Alum Rock School District for the past eight years and during this time I have seen police Target black and brown students on Alum Rock campuses with devastating consequences for these students and their families I know that you all believe in and say that you're committed to creating healthy supportive learning environments for Alum Rock students and that is impossible with police on campus policing in schools is a false solution that makes our schools students staff and families less safe and actively puts them in danger um I know that you shared some research um trustee beherano um but I would be happy to share and I think any of us would extensive scholarship from the prevention Research Center General applied

251research on children American Journal of Public Health that actually shows that there are no positive impacts from having police on campus and that there's a negative impact on student safety on student Mental Health on anxiety rates on student performance there's extensive research that shows this policing in schools is a false solution and this is a moment for courageous leadership you have an opportunity to take a stand for student safety and well-being for restorative justice for counselors for art programs for equity-based Solutions and not only is it the morally right thing to do it's also what it's effective the research demonstrates time and again that policing makes students less safe and undermines learning a school district that invests in sros in any way sends a clear message to students about what is expected of them in

252this world so please take a stand not just for this year but for every year for good take to stand with students staff and families for safety and well-being thank you thank you next speaker Mr Gill some blender inside the house listen they have when your microphone is unmuted you can begin to speak and your two minutes will begin hi I want to speak quickly on a committee that was formed it was the reopening Committees of the schools I had sent an email asking how these parents were selected and how I can get involved I don't know how superintendent decided to form this committee but I do know that a lot of parents from spacemakers sent emails and requests to be on this committee from what I was told the same parents from spark were

253in the emergency committee and also on the reopening committee I don't understand why the same parents are being used and these committees are not open for new parents voices I understand that you guys have been meeting for two months I would love a link to be a part of this even if I can't participate I think any committee should be open to the public I want that information and I want this to be open and transparent this is not transparency when you have a group of five parents and three committees and it's a very it's very quiet I don't know if you board members know about this but this has been happening and I'm very involved and I'm very interested in seeing what's happening this should be open to the public and that's more policy

254and also I want to say that I feel a little betrayed uh and then somebody hit I don't know you brought up that you were at a forum it was a public forum and I believe somebody asked you if you were willing to meet with parents after and you said you you I think you said you couldn't and so they asked you respectfully to leave if you weren't willing to listen to parents and I feel betrayed because I feel like you took a lot of the points and twisted it to your advantage that's not right and I do call on your resignation because you're not standing here as a as a person to listen to your constituents you're not you're not here for the you took your kids out of the school what is the

255purpose of you sitting here if you don't have kids in these schools you ran as a parent but you're not a parent anymore [Music] thank you just a quick clarifying Point mom I did not take my kids out of schools they both uh proudly graduated from Alum Rock schools and moved on to high school next speaker Mr Gill Victor Vasquez Mr Vazquez when your microphone is unmuted um you can begin speaking and your two minutes will start thank you so much um this item definitely is not a on the agenda but he said Union just seven to zero decided to um end their connection to to the sros and police and they did it in a way that they actually talked to you know community members that brought this attention um there was price around

256the effort there was really no Direction it was something that they you know staff took on and they did and they were really listening to the calls for ethnic studies they were calling for counselors they were calling for trainings for teachers for the escalation there was a lot of different things that constituated real safety for the students that are long-term and some of the data that they actually used was to to look at how low or high you know SRS were being used in suspension but their end goal was to actually have zero their end goal was actually to to figure out a different way in a different purpose right um and so you know one of the things that was mentioning is is that funding and I agree I think that even though it's

257a small amount to look at I think it still matters given our budget situation it matters that this funding needs to go to our students like I mentioned earlier there was a study done where if you look at page 47 of your 2017-2020 well actually page 46 lcap it shows that we are using funds that um are associated with low in low-income English Learners and Foster Care kids that money should be going to enhancing the type of activities identified by Community Counseling academics Arts Early Learning opportunities that's what we should be using it for and so part of that study mentioned there's 56 districts out of compliance with that so I'm wondering I'm wondering are we one of those um but I hope that we can change that and move forward and yeah let's call

258for a vote in July appreciate you all thank you thank you next speaker I'm assuming we have more skill is that correct yes we have four more Natalie hey Mr ball um when it looks like you are unmuted so when you begin speaking your three minutes will begin hi I just want to say one thing that's very common with our most vulnerable kids is trauma and I police officers are not trained or educated to handle kids to the root of their trauma and you know we have schools on the outside there's Esther B Clark and other schools where schools if if they aren't able to work with students who have those needs you know they go to these special schools and one thing that these schools are not armed with they are not armed with

259officers and they have kids with the highest behavioral needs they are armed with counselors they're armed with trained classified staff that have behavioral background they have therapists they have the Arts you know they're armed with the right things not police officers and these are people who went to school and they have the training another thing I want to point out I'm very disappointed that you know I feel like the community is it's easy to shut us out right now because we do everything online and I feel like you took advantage and exploited your own agenda and points by using your research you know and when we don't have the same opportunity to present research that shows otherwise and to be honest I don't trust her research because if you were to go on a Facebook

260post that you just posted yesterday you reposted something from somebody by Kristen Thompson and what you posted without realizing if you would have clicked and saw and read it in less than one minute you reposted a false article and somebody that is a racist and a Maga supporter like that's very careless so don't tell the community bring your research and you do your research when you can even take the time on a Facebook post to see that you posted someone that's a Maga supporter and a racist thank you next comment next is buckling yes um hi I also didn't get a chance to speak on Public Safety my name is Buckley I'm an extremely concerned Community member and I urge you to take action on this agenda item swiftly it's imperative that we defund the

261police and use these extremely scarce resources to fund other necessary School resources I urge the board to put their commitment to deepening the police like you've all mentioned into writing sros are police calling them sros sugar coats that these people are police and that these people are policing our students and ultimately our community members police are an arm of racism and oppression sro's presence alone is the presence of cops community policing is an oxymoron a contradiction research studies student testimonials and Community Voices have testified again and again that please do not make us safer they do not prevent harm from happening they do not support Community healing when harm has happened I urge you to lift up black and brown and Indigenous student voices in Alum Rock they and their families and their communities will

262tell you what makes them feel safer things like culturally responsive mental health services safe and stable housing access to food Financial commitments to anti-racism in their schools Empower students to share with you and create their own safety outside of police and policing outside of sros I urge you to put in writing and to take action on removing pulleys including sros from Alum Rock cancel your contracts reallocate these funds to support the actual supports that keep students safer that keep us safer put this commitment in writing I urge you to do this now thank you thank you next comment Mr Gill we have about six more minutes for the 20-minute time Espinoza I didn't hear the first name but Mr Miss Espinoza when your microphone is unmuted you can begin to speak and your clock will

263start oh yes um this is Tim Espinosa and I'd like to share actually a quote the Youth of today are not the enemy but our future our commitment to them their safety and their success is evident by the way we treat nurture and respect each child we need to close the pathway that takes students from schools today and places them in jails tomorrow and that was by Eric S Hall so in the in the spirit of conducting research from unbiased sources like scholarly peer-reviewed journals I came across a study conducted by Jeremy Thompson titled eliminating Zero Tolerance policies in schools Miami-Dade County Public Schools conducted in 2016. the results from the study suggest that what we already know the urban class problems are rooted in structural racism racial segregation and economic inequality instead of recognizing

264the effects of inter-institutional racism school officials and police officers often expect to underclass to pull themselves up by their bootstraps when the underclass is not conformed to these Norms school officials and police officers Institute Zero Tolerance policies because of implicit biases minority students are suspended or expelled for the same offenses that white students commit but are not expelled or suspended for committing it's clear that after these last few weeks of public comment asking the board to take action and remove police from our schools that it's time for the community to take matters into our own hands and find those who will listen and respond to our needs thank you next comment Mr Gill we have time for a couple more floor de Leon Miss de Leon I think you know once your microphone is open

265you can begin and your clock will start uh um again this is flor de Leon and I am a part in a community organizer in Alhambra so I just wanted to say that um I would like uh you for you the board to have a discussion uh have uh can you pause or clock Moneyball shoes I'm Sorry Miss de Leon can you start back a couple seconds you're you're breaking up there when she begins again Mighty Bell can you start it back up go ahead Miss de Leon good evening again my name is flor de Leon I am a parent and I think that all right and I just want to see you guys to have time to discuss of uh having a newborn member uh new new president for the board that learns to

266do better job than what we saw today because today that the meeting was out of control but also I I I I think it's time to have a timer for yourself when you're speaking and maybe uh try to figure out what we need to do in order because you know like to be able to uh also I I believe in the past and I don't know Rogelio I cannot ask I know Rogelio is the lawyer but I think when people is doing public comment you should not even be commenting because you have your time to speak so I don't know if we need some training or or what but hopefully everyone goes because sometimes when there are training not all of the poor members participate and and even though they need it so what I'm

267asking is please um um have that conversation and if there is anything that you guys can do to uh have more control of where we're seeing you know right now it just looks back and brings memory her past board members when we used to have these that people was having their public comment and their time because we only have two minutes and uh and then they get interrupted by other board members so please uh conduct yourselves and get some trainings uh come more prepared to your meetings do your research if you have a lot of questions talk to the superintendent clarify those questions and when you come to the board you already done your homework thank you if I could ask uh clarifying questions so your your statement about um about board members speaking during

268public comment you're specific I'm assuming you're talking about um interruptions during the actual comment is that is that accurate Miss de Leon okay thank you okay we can do one more Mr Gill Cynthia Toscano okay Miss Toscano when the you are unmuted you can begin speaking and your two minutes will begin thank you uh yes I only have a strong suggestion that for when this item is brought to action and was ready to take a vote upon my strong suggestion is that you bring unbiased information and facts to the meeting as you mentioned early on um you have a responsibility and your actions do sway public opinions so when you present bias information you are making a clear stance other than putting this as an action item and ready to vote for the next meeting

269and preventing unbiased information there's no further action requested upon you you have made your stance very clear as a president of the school district and I also want to express my overwhelming support and pride in the community members that took time to email and to courageously speak during this meeting I will support you in your continued journey to be advocates for our children and for our community and I will support you if you choose to ever run for future positions on the school district to replace the members or presidents or any other leaders on the school district that do not have the best interest knowledge connection cultural awareness to support our families I yield my time to allow 43 seconds to other members to speak thank you for your comment um so we are any

270let's see that was item 4.01 um just to clarify to Mr Ruiz and in this format are is public comment subject to yielding time to another speaker in this scenario if so we can give 35 seconds to the next one but no as as best as I can remember this this board's policy has not been to as to has been to not allow yielding the time okay um I I you know I will Mr uh Mr Gil do how many more do we have so so we have two and I believe Victor Vasquez already spoke okay so why don't we go ahead and finish up with that other one um and then we'll move on to item 5.01 we'll go with the two minutes not 35 seconds or whatever was attempted to be yielded who's

271The Speaker Gonzalez okay Miss Gonzalez I think you're unmuted so when you begin speaking your two minutes will begin hello bored I'm just um here to Echo weather on cassette uh this is a really biased presentation that you just gave of President and if you really want to get research from the community to people then be open to get research from people from resources that you might not agree to because when we talk about real research we talk about having an open mind and being able to learn and and being able to change our opinion our personal opinion based on research and all you have shown today is that you only bring research researchers that benefit you and the way that you think and another fact and another point I wanna Echo and I want

272to say this as a parent from the Island School District of three children that ten thousand girls and as a former student I do not like the idea that you presented or having a closed session talk with sros and and make a plan and then come to the board and present it to the public you're really hard for transparency you need to let people community members parents especially and teachers be part of that of the of that meeting and be part of that of that talk and being able to be part of the of any kind of money that you guys that you guys want to have there is no transparency when you do not involve parents and teachers in any kind of conversations you have do you have with sros on behind our backs

273and you're just trying to come and present them because you already made your your idea and you already have made your decision if you're really about transparency let people let parents and and students and teachers be present in any kind of conversation you're going to have in that future with them and that is all I have to say be transparent be that kind of what you're accountable to us and I am requesting for that conversation to be open to the public and to us especially thank you have a really good night thank you just a quick clarifying comment on that particular item that is the way that I described it is the way that it's laid out in that particular board policy as a discussion in closed session that's not my um decision or preference

274that's just the way that I read that board policy if if I'm incorrect about that um you know certainly staff will point that out to me um and we can you know modify that but that's the way I read the PO the red the um the processor protocol in the board policy um and another uh response before we move on is I am open please everyone send me that research I whether people it's good enough for people or not um I do have an open mind and I would like to see that research and included in our decision making or my decision making so please um email that to me okay so we can now move forward to item 5.01 Teamsters do we have any comments from Teamsters I don't see or hear anyone so

275we can move to 5.02 CSEA Sharon Sharon Fontaine is here okay is she unmuted I don't see her here I'm assuming s i is Sharon Fontaine and she is the president of csca yeah she's on mute I'm can you hear me oh Sharon's iPhone yes oh okay yeah and everybody can hear me I believe so yes okay um good evening Dr Bauer superintendent and board members I am here to speak on item number 9.03 the resolution number 42 slash or Dash 1920 the reduction or elimination of classified services and it's unfortunate that I've have to be here to address this for the second year in a row the classified layouts for a CSEA last year we absorbed 24 members affected by the layoff with the result of bumping into previously held positions however there's a

276significant number of those of our members that are still on the 39-month Reemployment status and CSEA is absorbing the majority of the layoffs again not and I'm not speaking too certificated only to classify which would be classified management confidential teamsters and our unit so um and we have affected about seven ftes this year and we know that the accountant and the office assistant are vacancies the office assistant three our vacancies those are not an issue however the certification specialist the senior accounting assistant para Educators and the library technicians do have members occupying those positions and some of them will be able to bump into a and maintain a position however there will be some that cannot and usually when somebody bumps somebody there is somebody that is affected that loses their job unfortunately we have

277not had the opportunity to meet with HR as of tonight to go over all of the the bumping process and the seniority list so um and I know that you're all aware of that AB 77 trailer build that is going through legislature right now and I know that the budget has not been signed by the governor and there are two or three days ahead that it supposedly will be and that part of the legislation is that school districts will be funded as they were last year and the recommendation is that there be no um classified layoffs due to lack of funds for either you know County offices Ed K-12 education or or anybody it covers pretty much all of Education and we would have our leadership would have appreciated having the opportunity prior to the

278board meeting to have spoken with the district regarding all of this decision making and then we do understand what the covid-19 pandemic that some positions would need to be eliminated however our feeling is that those should be vacant positions not positions that have employees in them that as a Alum Rock Community we have an or moral obligation to maintain employment of these governmental employees we are essential to the business of parents students and staff it is a fact that the governmental entities are doing their best to keep people employed as during these difficult times there are very few and limited jobs for people that are because there's been so many layoffs and that you know people do need to be able to pay their rent buy their food care for their families and then once

279again similar to last year we have a single 10 position as you know we have have an unfair Labor practice pending regarding the same thing that happened last year it is mandatory to negotiate when you're laying off a full class or a single position prior to it taking place as we have a right to discuss the decision-making and the effects of that layoff and that this year is the library technician we have no Library assistance we have no one that works with us books except for this one position and this is a six hour position so this is not going to save the district eight million dollars or four million dollars so um we would we would like the district to consider this and the board to considered this and we respectfully ask that you

280do not approve resolution number 42-1920 thank you thank you um moving on to item 5.03 Alum Rock administrators Association I think I saw someone here are they still here do we talked about you know if we have anyone from araa um but yes okay um are you are you able to speak Maria um I'm unmuted okay perfect um I know I believe Tara was gonna jump on as well so um hello everyone my name is Maria Martinez I am the proud principal of Adelante dual Language Academy and I am also the um new uh Alum Rock administrators association's president for the upcoming school year and I just wanted to take a moment to let you all know that this summer your Alum Rock administrators and management team have been invited uh to engage in a

281book study um around racism and how it impacts our schools and our students so that is one of the activities we will be engaging in um and we just wanted to let you know that even though some of us are on our non-duty and and you know moving things along um we we are definitely keeping um you know what's going on in our political climate at the Forefront of the work that we're doing to support our students thank you thanks Maria um I was trying to jump on to introduce Maria for you guys but I was muted until she got unmuted so um just wanted to say thank you to everybody for um the year we've had and araa we've made it through this year with everybody's support through all the ups and downs and

282I couldn't be happier handing off the torch to Maria and seeing where she takes us next so congratulations and thank you everybody that's it all right thank you um item 5.04 area I know I did see them here trustee Chavez did you have a quick question for Maria if that's okay yes for Maria Martinez she said that she invited them and what though what are those dates and I think she said Administration did you who else did she say yes hi good evening uh uh trustee yes so uh we as our Alum Rock administrators Association have invited the management team um you know and our which consists of our principles and and all of the uh search management uh certificated classified to to join our book study uh we're reading the book anti-racist um and

283so uh we are actually using Google classroom as a way to house the information and we will be setting up Zoom meetings to have our book discussions um so that is uh the platform we're using for our book study we're waiting for the books to come in um and so they should be in within the next couple days and then once those are distributed we'll um start planning out the meeting dates is there any way possible that whatever questions or something or if we can get some kind of information after you guys have that um because I think it would really be helpful to the board um yeah as far as um sharing out uh we can we can provide that as well yeah that shouldn't be a problem um thank you yeah no problem

284thank you appreciate it thank you um so we're back to 5.04 area I believe Jocelyn are you here what's up I saw it earlier do you see her Avatar yes I do I just I'm here okay um thank you I I have something that I wanted to say regarding a while ago about the budget but I didn't make it in time um to uh before the time was up but one of the things that I I just wanted to shed some light on I didn't know if it would help clarify I know uh trustee Marquez was questioning why she didn't see the the elimination of certificated positions in the book and that is because there is not a need for actual layoffs because we have far more people that have resigned or retired that will

285take up those 30 positions um that the district is planning to reduce so hopefully that adds some clarity to that and then I also want to Echo what um Victor Vasquez spoke about earlier on and that is that one positive thing that everyone can do is to help to pass the schools and communities first legislation that will be on the November ballot providing billions of dollars to the schools in California so moving on from there I want to thank trustees Quintero and Herrera loera for taking the initiative and acting so quickly to bring forth the black lives matter resolution that's on tonight's board meeting agenda it was my misunderstanding that has caused area to delay in bringing forth the one that we've been create that's been created by our Equity team I thought tonight was

286a special board meeting and not a regular one and so we were planning to bring it forward to the July meeting which is still the plan and um it will be clear to our community that both the district and area support the black lives matter movement hmm on another topic as we are all aware very well aware we are experiencing a worldwide health pandemic that is affecting each and every one of us in some way I for one am extremely appreciative and grateful for the front line workers who risk their own health to care for others they are the real Warriors in this fight so in with that in mind there is something that I think you need to be very aware of Alum Rock Services approximately 9 000 students assigned to address the health

287needs of these students are two and a half full-time nurses which is a ratio of one to thirty six hundred students the National Association of School nurses recommends a minimum ratio of one to 750 students our district exceeds that recommended ratio by almost five times it is also important to realize that and I'm sure you are well aware that the 95127 ZIP code is one of the four zip codes that has the highest rates of covid-19 in the county so it's all of this in mind you need to also be aware that one of our full-time nurses who has served our district for five years recently resigned to take a job in another district with she will where she will be servicing half the students with more nurses the very sad thing about this is

288that she didn't want to leave Alum Rock her heart is with the students that we serve here but when this board and the district's negotiating team refused to put the nurses on the same salary schedule as the speech teachers and school Psych the school psychologists salary schedule she was provided uh the opportunity to move to a surrounding District where she will be her commute will be shortened her workload will be cut in by 25 I mean by 75 percent I believe and she will be making seventeen thousand dollars more per year she needed to do what she what was practical and best for her family I also want to add the last year we lost another nurse who had been in Alum Rock for 10 years and if I'm not mistaken it took that position

289was vacant for close to a year and that when there's a vacancy such as that there aren't nurses that are flocking to come to work in Alum Rock and not because it's not a good place to work but because well first of all their ratio is high of students that they service and also um because they can make much more in other districts or in the private sector so when we can't fill a position and we're forced to contract for a nurse we end up paying more then what it would cost the district to move the nurses over to the other salary schedule um and I mean again we're in a worldwide pandemic that is greatly affecting this County I don't know how the one and a half nurses that are on staff are going

290to possibly service the needs of the 9 000 students that we have coming up this next year so I'm telling you this because I think it's time for you to take uh a careful look at the valuable assets that you have in the way of the area unit members rather than being so quick to dismiss some of our requests consider the effect it is had on our students and Community when we lose these assets to other districts that acknowledge their value in this case the nurses teachers are really not greedy people quite the contrary these last few months we have witnessed the Great Lengths the teachers and area members have gone to provide the educational and emotional support for our students and their families and often at the compromise of their own expense and of

291their own families and children they have proven their dedication their flexibility and their ability to adapt and learn how new ways of delivering services and exactly how are we showing how are we being shown our worth we aren't in fact we're still bargaining reopeners for an agreement that should have been settled over 15 months ago area has made significant movement from our original proposal which wasn't an unreasonable One to begin with District on the other hand has barely stepped off the start line as a result we have let a valuable nurse slip away when it wouldn't have taken too much to prevent that from happening it's really up to this to you the school board to make some decisions that will ultimately shape the design of where this district is moving thank you Jocelyn um

292we can move forward to item 5.05 superintendent I'm gonna pass for the sake of time thank you okay item 5.06 Board of Trustees Communications um I'll just I guess call the way I see you on my screen if you have anything or if you want to pass or whatever you'd like to do trustee Chavez can you come back to me I gotta find My Notes yes uh trustee Marquez are you there trustee Marquez yes I am okay do you have anything for board member communication yes I do Okay so you want to take this this to have been writing notes and rewriting and throwing paper away and rewriting you should see my bedroom and My Bed full of rewrites and the only way I can do this now is just to say from my heart

293that I am so so sorry that I really let comments from one of my colleague get to me I really did and um I want to apologize very sincerely that I should know better but I'm only human at some point some of us just we can't hold it no more and I want you to know that I have been trying very hard to work with with traffic in general and um it just um it's just a very difficult thing to do and very hard you know to just keep your mouth shut and not say anything but I know that some of the things that come out are misconstrued or lies or you know just painted an awful picture so my sister apologies to those parents that called us out on it you know kudos to

294you you should and my sincere apologies to those that um that you know that feel like Ellen rock is not where they want their children to be I'm I'm sincerely sorry but my heart is here in Alum Rock and I'm not going anywhere I I'm ready to retire from all of this I am I am not looking for a stepping stone like some of our our um some of my colleagues are and have been um this is where I always wanted to be didn't want to go to City Hall didn't want to go to the County Board of Supervisors I I just wanted to stay here and help with however I could help and um I just want you to know that when the elections come you will have an opportunity to change this board

295and I hope that you will do the right thing and you will help that one person that could come in and change this board Dynamics and um I just pray that you do the right thing so again I apologize to my colleagues and I will try very hard from here on did not let anybody get under my skin so um forgive me please thank you I'm finished thank you trustee Quintero I think I was next oh you ready now okay yeah trustee Chavez I'm sorry unless he wants to go first he can go ahead and go first no I go first okay um on a on a good note on the city council meeting on the June 23rd the item number 3.9 the city council was voting on the digital Equity Coalition and they committed

296to put resources to long-term Broadband infrastructure in San Jose and devoted it into the the upcoming fiscal Year's budget and the bridge to the digital divide the ACT uh requires that the city to meet the needs to improve the Broadband access in the under underserved areas where our students live securing affordable devices to meet Alum Rock family's needs and the facilities um their access to the their access to this is so important and I want to thank um Eastside Union High School District for putting this uh forward and they've put quite a bit of money into it too and I know at this time we're not able to help out but because we are going to benefit from this as well I think that if money should ever clear up down the road a year

297or two from now or three years who knows that maybe we can contribute some too um because I I I know myself I've experienced a lot of problems with the zoom and um sometimes when I call I I know that uh the call gets dropped and and uh I I know that it's frustrating for the families and um I've had to call in and and if the children are using this to to this same system and they have the same problems as me I know that it's impeding their audio and visual learning and they're learning overall and what is needed to provide proper service for everybody we don't want our students to miss out on any opportunity and I believe that we should have a discussion of the future technology the needs of the students

298and the parents and figure out how to better address and reform the Improvement uh to the students education and the student learning this Paramount and I know that how we do how are we going to do as far as educating the parents to have the access of the internet I know that some of them have to do it through the phones but um if we do need the access we we do need to identify which students need the extra help and I know that the district has been working very hard and getting all of them the hot spots but we also have to help the parents and because there is in like in everything there's good things and there's weaknesses and I think that we should address that later on moving forward but let when

299we move forward let's do it at a quicker Pace because the solution is uh right now is the the maybe we can come up with maybe hiring and I know this sounds horrible especially with the layoffs that we're facing but maybe we need um temporary internet Consultants uh to expedite the suit the students learning so that they don't fall fall so far behind thank you thank you trusty Quintero foreign well just uh to iterate uh thanks uh to all the folks that have been here I know that we still have a good group of of people there's actually more folks that are than usually show up to our meetings and so that's a great healthy uh exercise in democracy and so thank you for that um I do appreciate the the apology that uh our

300colleague provided to the board um I understand that um the old adage says when you put out facts and you know they might make people uncomfortable um with regards to the things that I stated nothing that I said is isn't anything that isn't in a public document that can be scrutinized by the public many of you have already seen it so um with that I'm glad that we can set a different tone for this meeting as we can uh and then we can move forward and be more efficient and get things done um as we're getting ready uh to to to move ahead and uh and and plan for the future we see the the stats um the questions uh have have been raised in with regard to the need for more clarity with folks

301out there in the community as to what our next steps are and so I just wanted to bring it to the body and to uh Express um the concerns that I've written that I've heard from community members as to um if we can figure out a strategy I know that when things are being um developed you don't want to put stuff out there because it might change but um if we can figure out how to relay a broader message to folks our next steps in preparation moving forward and so that's something that I heard from folks that I've talked to in the community and so we can we can start laying out a plan so um I know we have a bunch of stuff ahead so I'll cut off everything else themselves thank you all

302thank you yes um first of all happy Father's Day to all the fathers this past week um and also I would like to uh let the community know that I was recently reassigned to um the county of Santa Clara's emergency response um Team um as a public information officer and so I mentioned this just to reiterate uh the fact and I know Jocelyn mentioned you know some of the numbers and I just want to reiterate um that our community our latinx community is testing at higher rates so we are 40 of the positives that are coming out um as we speak and unfortunately most of those numbers are in our our just our district our ZIP code um 95127 as Jocelyn mentioned being one of them um and so just want to remind folks to

303wear your masks you know practice uh social distancing um just be healthy you know uh we get to take care of our community you know show up to meetings and do all that and also you know just in our everyday living um I unfortunately go to the store sometime and then you know I see I see folks without masks and things like that so just want to reiterate and remind our community um also I want to highlight that in my tradition my culture we just honored um the summer solstice and it's when the sun shines the lightest in the year um and there's no accidents you know I right now um as we all know we're going through you know some very trying times um but you know the issues that are coming up you

304know um it's a light shining in the dark darkest spaces um and as I mentioned earlier you know that truth always comes out um and so you know you just want to um remind everybody you know continue to show up continue to speak up um I look forward to having conversations and moving forward together you know my daughter you know I'm a parent first and I was never I never thought I'd be here as a trustee but somebody said hey we want you to you know go there and be on the board and here I am um and so you know I mean white supremacy unfortunately is also prevalent right now I mean it's always been there but as I mentioned this you know light is shining on the truth and um you know the

305the dark spaces and dark energy days and dark you know behaviors are no lot longer being allowed to hide within our institutions um within our you know um spaces and so I look forward to continuing to work together as a community um to continue to uh bring the best and be the best for our children um thank you to all the parents who Express themselves and I look forward to you know having the dialogue the back and forth um with our community thank you thank you um I just want I guess I'll just quickly piggyback on trustee Chavez's comments regarding digital Equity I know that um um trustee Chavez and myself and I believe others have been ongoing advocating with the city and the county um to bring those you know resources to our community

306and so um thank you for bringing that up trustee Chavez um I also another point that you made earlier and I think trustee Quintero has brought up too is that you know as part of as part of being a part of this process I think healthy respectful dialogue is part of it and it's been brought up before that we you know we can disagree and still have a fruitful conversation as long as we keep in mind you know what we're what our goal is at the end of the day which is the students of of this district and you know we can disagree on how to get there um but I I don't have any doubt in my mind that anyone in this meeting and outside of this meeting that pertains to this District ultimately

307has that goal in mind so you know I don't expect everyone to agree with me and I don't expect to agree with everyone always but as long as we can be respectful of one another and you know have dialogue and differing opinions and different you know um sources of information and share that and and look for common ground I think we're going to be okay I think when we you know when we get away from that when we get away for what our true intention is at the end of the day then that's where you know it becomes worrisome to me and so again I think we're all here for the same reasons that's my opinion how we get there sometimes where we differ but I think with the foundations of trust and respect you

308know we can we can do a lot um and so in the interest of time I'll just leave it at that um so thank you everyone for your comments um so we can move to item 6.01 an action item to approve approval second we have a motion and a second to approve item 6.01 is there any questions or comments from the board on this item okay do we have any public comment on this Mr Gill or Mr Sanchez there's one hand raised okay Mr Sanchez emails okay for now while he gets set up um Mr uh moneybab can you get the clock ready and Mr Gill can you so we'll go two minutes again um 20 minute cap obviously we've been doing that for the majority of these items now um and we uh the

309first person can go ahead and we can unmute them who's the first person or the person that has a comments hey Veronica you have two minutes when you begin speaking [Music] um before I begin again um can you repeat what this item is item 6.01 approved I do not appreciate you chuckling uh whoever Dolores is ah trusty Dolores I do not appreciate you struggling because we call you out on your stuff as well but anyways go ahead the item 6.01 approved the contract with accountable Health Care Staffing Inc oh yes of course yes yes uh definitely approve it you know definitely approve it do not approve police in our schools we have and thank you for bringing a doctor um excuse me not doctor not not even there yet right um which we're asking for

310your resignation um those photos of the petitions that the community has to put out there right we have over a thousand people asking to defund the police right how many more people are do they need to sign for make sure that you put it on an item not as informational but I'm sorry is this to item 6.01 about that okay thank you yes and like I said we're putting once we defund the police we're able to even put more resources out there right and to fund things like mental health and put more mental health in our schools and again if you are how many more people need to see and how many more people need to sign that petition um because you know to defund the police and reassign that money to reinvest in our

311children how many more uh president how many how many times do we have to ask you to resign because if you don't stand with defunding the police there is no common ground right you don't stand with black lives matters or are children of color once again uh I yield my time for anyone else I would like to speak thank you any other comments on this item Mr Gill none okay uh so there's the motion and a second on the floor for this item um yes before we both before we go to the vote um I'd like to apologize to the young lady that just finished talking it wasn't a chuckle on her my husband walked in opened the door and I chuckled I said yeah I'm still on the until I was still on the

312meeting so it wasn't anything to her it was because my husband came to check in on me to see if I was still on thank you I'm sorry that I'm sorry that you jumped into a conclusion thank you um so I don't see any further uh questions or comments so we can call for a roll call vote on item 6.01 um trustee Chavez are you there yeah okay trusty Chavez yes trustee Marquez yes Quintero hi trustee yeah can you repeat that I didn't hear thumbs up yes okay thank you and myself yes motion passes unanimously item 6.02 for approval motion there's a second um is there a public comment on this item Mr Gill or my son Mr Sanchez man Mr uh it's from the same person Veronica okay so this is for item 6.02

313the contract with Lozano Smith um when your microphone is unmuted you have two minutes to speak to this item great thank you so much again uh again great job on bringing resources is that our students need let's go ahead and defund the police let's go ahead and put that money and reinvest in our children such as this resources that we're approving right wow great decisions that we're making in this small period of time by the way I do not also appreciate your lecture I'm not in school okay um president I'm not I'm not in school I'm also um a professional out there in the field and I do not appreciate you bringing your Facebook resources which are not even peer review okay listen to the parents that are bringing peer review resources to re to

314and then put what resources we need right resources like this resources that will support our children and not resources that will damage and criminalize them such as the school to prison pipeline um again defund the police I don't know how many times we have to say it will be here we will be here okay and we will stand together it is not just me there's more and you can see it I yield my time so just a clarifying question the um research that you're referring to is that the research that was referenced um from the Journal of Criminal Justice I believe it was is that the one you're referring to um you know that parent put out that research um but if I can bring that parent I believe it was uh his name was

315Tim Espinosa and he brought that research um I don't recall on it but I did look into it and it is peer review it is not like your public posts that you're taking from Facebook right it is not it is not your public post that you're taking from Facebook I'm sorry it is not your public post that you're taking from Facebook without any credentification without even clicking to see what that is already you are standing against black life matters okay thank you for the clarification races the next speaker Mr Guild do we have another speaker on this one or is that it I said that's it yes sir okay um so is there any questions or discussion from the board okay so we can call for the roll call vote on item 6.02 press the

316Chavez yay trustee Quintero all right trustee Marquez abstain okay and myself I so motion passes for in favor one abstention trustee Marquez um item 6.03 for approval motion to approve motion and a second uh do we have public comment Mr Gill or Mr Sanchez on this item then we are one from Veronica okay Veronica when you begin speaking your oh wait Maribel do you have the clock ready thank you okay when you begin speaking a few minutes okay great again my name is Veronica I am a parent of two uh two Island Rock students and I'm also a community organizer and I'm also here in support of the resources for our children right the ones that we are approving and we were approving again I'm not and we asked you last time to put something

317into the agenda to be itemized and you put it as informational you took that deliver it and then you went on to Facebook and got started getting information that it's not even true that is just oh I I don't even know and you have a master's in social work and you stand with the police you should know how that affects our children you should know how their research does not stand with the police right because apparently you're not even reading the articles that you're putting out there standing with racism's confederate people and not with the black lives matter I stand with black lives matter and that's why I stand against funding any type of police in our schools now people want to know how we can um have safety programs there's a million other schools

318that are doing it without police right this is not something so radicalized this is not something new there are things that are happening East High School this is a union um just passed that they will not be funding the police congratulations to them we as Alan Rock can't even put it as an item action so embarrassed just be unembarrassed I yield my time okay Mr Gill do we have any more public comment on this item and no motion okay we'll put it into a roll call vote uh trustee Chavez justy Chavez I didn't hear anything I'm sorry my internet's going out can can you say that again yes we're um we're voting to approve item 6.03 I okay uh podcast hi Quintero hi trustee and myself I who motion passes unanimously item 6.04 approval contractor

319sorry can I ask something secondio if you can put yourself on me a asking the question um are we allowed to comment back and forth with our public any one of us when they're doing public comment Mr Ruiz Rogelio talk about bathroom break maybe okay we'll come back to that I just wanted to clarify because I'm thinking we can't Ernesto and I just want to make sure that you know we're following the law and um yeah I appreciate that yeah I appreciate that it's important that we follow the the brown act and and you know my understanding is that anybody is allowed to ask a brief clarifying question or comment um there Mr Reese did you hear the question no I didn't I'm sorry uh so I'm just wondering if we are allowed as trustees

320to um either ask the public um in relation to the public comment or comment on their comments so so generally no and the reason for that is unless it's dealing specifically with an agendized item so if it's if it's an off-topic item then the answer is no it should be no it should just be you receiving the comments and then uh maybe you know a simple follow-up question but there shouldn't be any detailed discussion on it so so a clarifying question or comment then is allowed but not dialogue is that accurate or okay that's that's accurate okay thank you did you have anything further and I think it'll also help you know just move our meeting forward and not like you know clarify you know ask clarifying questions at every comment just uh sought to

321help our agenda move forward thank you okay so we are on we were about to start items to explain with four can I get a um I only got the who made who made the motion was just taking Dental I didn't get I don't know who seconded because they were I seconded it on 6.04 right correct okay yeah wait a second emotion from Quintero second by Chavez to approve item 6.04 um is there a public comment on this item Mr Sanchez or Mr Gill none okay is there questions or comments from the board okay Mr Gill there is one from Veronica okay Veronica when your microphone is unmuted and when Maribel has it clocked up you have two minutes to um for your public comments great again this is my name is Veronica I'm the

322mother of uh two Island Rock children um which one of them is actually here and has been here here in the um board meeting and I will yield my time to her hello my name is Isabella from San Antonio I am a student and I would like to say I want no police in my school police make me feel worried they make me feel not safe I'd rather have counselors than police police just waste your time and they make sure you're if you're late or not but counselors they help you with everything they help you with your emotions they help you with everything you need that's all thank you Isabel or Isabella I'm sorry I didn't get it but thank you that's a very smart and brave thing to do thank you okay um we

323have and is there any comments or questions from the board on Aida um uh seven I was 604 right 6.04 excuse me I think we need to extend the meeting oh yeah a move that we extend the meeting till 11 30. okay is there a second to that motion second okay questions or comments from the board okay so we'll take a roll call vote on extending the meeting till 11 30. trustee Chavez hi trustee Marquez yes Quintero uh I trustee and myself I so we will extend to no later than 11 30. um did we vote already on 6.04 I'm I'm getting okay so we can move now to we didn't take roll call of who how many who did an eye and um just like you did in the last oh um it was

324that one was unanimous correct but it was the motion second by trustee Chavez but you didn't take the roll call like you did oh we didn't take the vote on that one no you didn't oh we voted on the time extension correct okay thank you for that so trusty Chavez on item 6.04 okay trustee Marquez okay we'll come back I don't know if she's having technical difficulties trustee Quintero yay trustee uh trustee Marquez Marcus can you hear us yeah barely yeah yes okay and myself yes motion passes unanimously um we pulled item 7.01 so item 7.02 board policy Child Abuse Prevention this is information only um is there any questions or comments from the board okay is there any public comment Mr Gill or Mr Sanchez none okay I just got from Veronica okay Veronica

325when your microphone is unmuted and the clock is up you can begin speaking in your two minutes will start thank you great thank you again my name is Veronica I am the mother of two Island Rock students and um I believe this item it is on Child Abuse Prevention and Reporting which is a great thing to have in our schools um I know that funding the police it's only a 100 Grand but imagine just putting that much money into training or even more our teachers and education of our families into making sure that our children are not being um you know that we have those prevention programs um instead of putting them through some abuse because honestly that's what police officers um school resource officers do they put them through abuse right it might be

326not sometimes it is physical um most of the times it's mentally right already criminalizing them already putting a tag on them that they are criminals our children of color are black children are criminals right um so just imagine taking that money and putting out where it should go and making this an item and agenda where we can actually when you actually can vote right and stand where our community stand with black lives matter um again thank you so much and I yield my time thank you any other any questions or comments from the board okay um I just have a quick comment um for this Child Abuse Prevention and Reporting um I Dr Bowery I just wanted to clarify that I'm pretty sure you received There's an opportunity for for our staff to receive online

327training so so that will be made available I know that's not specific to the reading but um we do have that available as a resource for training okay thank you um so we'll go ahead with the roll call vote trustee Chavez information only oh I'm sorry information only move forward to item 7.03 comprehensive yeah we still have that comprehensive safety plan first reading any questions or comments from the board okay any public comment Mr Sanchez or Mr Gill okay Veronica when the microphone is open and the clock starts you can begin your two minutes great once again thank you so much my name is Veronica and I am the mother of two Alum Rock students um and I know we are talking on a safety plan here I want to make sure that that safety

328Planet actually does not take any police officers right that when my child who has some kind of a disability um autism um has a crisis you're not calling the police and you're actually calling a mental health specialist right and having a police no matter if he's an Elementary or middle school whatever he is at I do not want the police to be called I do not want the police to be fun by the dollars that it is there for being educational um having those safety plans are very essential right having those safety plans that um I mean uh president um as we ask for your resignation and hopefully in hopes that you start dedicating your life more into social work um become one of our social workers right that we can actually maybe call instead

329of calling the police and we can call you to respond to those prices right um and then again we don't stand with the with police officers if you want to stand with them then you can call them but I prefer calling a social worker I prefer calling a mental health specialist for my children as they're having a crisis and that should be in the safety plan there should be no whatsoever police officer involvement when there's a safety concern uh again thank you so much and I hear my I yield my time thank you so with no questions or comments from the board uh we'll move forward to item 7.04 approved board policy board training second reading is there a motion for that approval second there's a motion by trustee Quintero a second by trustied um

330do is there any questions or comments from the board okay um any public comment on this item Mr Sanchez or Mr Gill and then one from Veronica okay Veronica when the microphone is open you and the clock is up your two minutes begins when you begin speaking great thank you again um my name is Alan Rock um children um and goodness this on training right board training um yeah let's get that board training for you all because it doesn't seem one first of all you don't know how to conduct yourself um second of all you know it is just embarrassing to see that you are fighting in the public and putting your comments um as your pictures it was just quite embarrassing um and that you don't stand with black lives matter so when we

331and I don't say we actually you sign this memorandum today I want to make sure that you know that it is not going to be valid if you don't stand with defunding the police from our school right the funding the police for my school will actually get your name on that memorandum and validate that because right now it's not and if you're standing with police officers and all our children our communities are not listening to us I don't know what kind of training we should give you right or we should recommend actually for you all because um you say I know that we can disagree and and it might it's going to be what we say no it does it's it's not what you say it's actually what the community says and the community right

332now stands against the police having safety plans for our children and I'm going to be here and I'm going to be here next time and next time and I'm going to bring five more people and 10 more people right and we're going to be here all together fighting for this until you actually hear us until you actually listen to us until you actually take trainings that will actually improve your practice of being so unethical and so embarrassing thank you again I yield my time thank you okay um so we have a motion in a second any questions or comments from the board okay so we uh we'll call for the roll call vote on item 7.04 yes a hand got raised okay um so the clock is ready so who's the first one Maria Martinez

333okay Miss Martinez um when you are unmuted you can begin speaking and your two minutes will begin hi my name is us and second the Veronica comment I want to ask you uh another member of War I don't know what kind of training you get it but I know that that you get before the training about the the brown act but you forget all this training about the the what rules do you you broken so please get your training and also invite the parents to get the training together with you because you need to prepare the parents to be there and the board and you share you need to prepare the parents to represent our students so please try to get this training for our parents to be representative students that really really care about

334what the or students need and I think you need training for how can you improve improve your time and also how can you talking with the people and also how you can present this war for the public even what position you need to stay and and the soon meeting because I was told you I see only some faces and all their in in the faces that that or people that represent I don't can see it so please take in a good training before hopefully you practice this training that that what are you training thank you thank you I was the next speaker Mr girl this Brenda is in the house okay Miss index when um the microphone is unmuted you and you begin speaking your two minutes will begin hi I just want to remind

335you guys that there was a letter to the district who did ask that all trusting members must improve their governance and operations effectively to serve the community the audit asked for you guys to take Governor classes which a lot of you have been asked to take and u-board president declined you said you did not need it hahaha I will not name the rest but you have all been called out to take training and I have not seen any of you guys take it before you took this position you knew the requirements because this article was written before you took a seat I think that governance training should be mandated to take I don't think it should be an option because apparently a lot of you guys need it I think you guys need to also

336understand how to read a budget because a lot of you guys have admitted not to know how to read a budget and I remember because I sat next to you guys um I really hope that you guys take this serious and really take this governance training because you cannot be an effective board member if you don't know what you're doing because an educational board is different than any other board and you have to understand where you're sitting and what you're looking at before you make any decision thank you thank you uh a clarifying comment or question Dr Bauer or yeah Dr Bauer the governance training that we all took that we responded I believe to the state audit um that was that was in response to the governance requirement from that audit correct the training

337that we all had in a special board meeting okay thank you um so we can take the roll call vote on is this the action item let's see yes roll call vote uh trustee Chavez hi hey trusty Marquez trustee Marcus can you hear us yes I said I you didn't hear me okay got you this time okay all right and myself I motion passes unanimously I'd um [Music] 7.05 we covered so 7.0 6 language access um I believe this came to us from trustee Quintero especi Quintero do you want to start on this one yeah um uh it's obviously not ready um but it was a place as a placeholder to kind of introduce the concept um the idea here is that uh the district has been um engaging in some good practices for um

338translation that type of stuff and uh actually we've been approached by folks who've been doing research on on the practices of translation and stuff that sort and being culturally competent in delivering language access and um and so the idea is that uh you know how have we memorialized what it is that the district is doing and so we've been kind of just jumping into it and doing things and so I talking to the administration Dr Brown in particular um I I brought up the idea that um time moves on people change and uh it's important to make sure that we through a board action memorialize the practices that we've been engaging in the people have been providing some recognition for our language access efforts so um as part of the conversation with the administration with

339Dr Bauer um the idea is to inventory the things that have already been taking place as well as go ahead and memorialize those things and the practices that we're engaging in already as a district so more to come looking forward to a more well-developed resolution uh and a first reading possibly next um I mean not a person but they all develop resolution next uh at the next meeting so okay thank you um is there any questions or comments regarding this item from board members okay um I actually just quickly I appreciate you bringing this forward I think um the staff here and and our district does an exceptional job in this area and I think it could be a model for um what districts do and many other places to to provide that access um

340for for people interested in in hearing and participating in these meetings um so is there any public comment Mr Gill or Mr Sanchez yes we have two one Veronica okay can we have the clock Maribel okay Veronica when you begin speaking the two minutes will begin great thank you again my name is Veronica and I'm the parent and of two Alum Rock children and also a parent organizer and actually president borva gerano as we asked for your resignation we also want to let you know that um actually we do not have very well um translation and access to a different language here in Alum Rock um I don't know who you're hearing it from but you know I'm out there in the community I'm making those forms right like the one that you attended when

341we asked you to leave because you wouldn't sit down with us and have a parent meeting um and so they're saying how awful it is the Spanish translation in the YouTube channel um and so that they can't even understand it that the two languages Collide each other but again if you would be listening to the community um but probably you won't anymore as we ask you to resign um you wouldn't know right so no please do not put Alan rock out there we are not an exceptional we are actually just very badly behind I um Eastside School District union today passed to refund the police and we can't even put it as an action item right we can't even hear what our families and parents are saying it's not just one person it's multiple people

342you have multiple people you had over 50 emails written to you right on this item and you couldn't even do it so no please do not okay it's painful and then we're having fights over here in the board meeting again very shameful unethical um and just I'm not proud right right now after this night I'm not proud to call myself an Island Rock alumni and I'm not proud to call myself an Alan walker uh parent because um because of the decisions that you decided to make and one is not stand with black lives matter one is to fund the police thank you and I owe my time Mr Gillen next speaker here's Victor Vasquez okay Mr Vazquez when your microphone is unmuted yeah and You Begin speaking your two minutes will begin hi thank you

343so much I appreciate that item being brought up uh I do feel that there there's a sense of History yeah I agree that the staff um has worked on this item but about 2014 2015 parents actually were at the board meeting asking for these translation services and ways to campaign to make sure that that was a priority why because as part of the lcat process parents are part of the decision making and input process in some way or another and how could we do that and provide uh English only or mainly English only information and services if um yeah how can we how can they do that in that in that sense so they asked and they started to work with the district and they actually had a couple of actions too to get to

344a point that translation and interpretation is is it's uh it's a something that's continuous in the district I do agree that there's some things that are really you all jumped on at the beginning in terms of translation and you continue through Zoom um County and other meetings are working towards that towards that end but I did see also a Nissan Union that there's a function that they use in their Zoom so that uh translation is integrated in the process um and you don't have to jump in through a YouTube channel or other means so there's there's definitely areas that um we can look at to to strengthen and that's not a bad thing that's that's a you know that's that's what we want to do always improve so I appreciate this item being brought up

345I also appreciate the uh putting that in history in a process for for it to continue and and yeah and there's any Improvement let's continue to look at our neighboring districts who also have some innovation in the process so yeah let's let's not forget it's also part of a parent involvement okay thank you okay um so there's no action on this item at this time correct trustee Quintero oh it's still being worked out and I want to make sure to bring it back and that it works out I do want to give credit where credit is due um and so while the parents did speak up and push for it um there was work being done by then well remember Andrea Shelton who had already been doing work at the county to increase language access

346and so you know we can just call that a parallel uh situation where you know it was a great Confluence of ideas but I do want to give credit to to then board member and therefore Shelton who did work uh with the administration to to push forward and and bring a um more language access to Alan walk as well so just want to make sure to recognize her work all right thank you uh uh okay so we can move forward to item 7.07 is there a public comment um from Maria Martinez on 706 right 706 yes okay okay Miss Martinez your looks like you're unmuted so when you begin speaking your two minutes will begin hi good evening good night uh um and board members uh one more time Maria Martinez I am patent grandparents

347and and and for two students in in San Antonio oh one more time I I and try to getting more information more context about this this point uh I'm looking in the book but they don't have nothing I don't know uh what uh what the information or what you want to put it uh about this point but like my college uh Victor say the parents always always in every meaning and be asking for translation I think that you need to improve the soon meaning you need to get that big soon meeting account forget that one line from parents that don't speak English one line for Hispano parlantes be together here and and be prepared more I know that we had the guy uh after I know the after is the the man they can do

348this they can improve this meaning and be uh inviting more patterns to don't support don't don't divide the puntings because the pattern and you too don't can talk Duncan talking don't be speak about the islands so please improve this this line this room and get that is together with with us thank you uh board president uh can I can I clarify really quickly so um there's nothing there because it's all being worked on and it was a placeholder on the agenda so um clarification all right thank you um so now we can move forward to item 7.07 after there's still one member from the community on 706 okay um who is the what's this okay Miss indejas when your microphone is unmuted your two minutes will begin when you begin speaking I I just quickly

349want to give a comment on this um I want to ask if there's any way we can add captions to the zoom link because there's also hearing and impaired having uh captions when someone's speaking makes it easier and even if it's in English or Spanish like movies I mean I think that would help in a way so that can be something that could be added I would greatly appreciate it um and that's it I use my time okay thank you any more after there is one from Veronica and I believe it's repeat yeah that so that I think she I do believe did she speak to this one yes what was that after I I believe so okay um Maribel can you confirm whether or not um I don't know if you have that Maribel

350said she did okay so we can move forward then to item 7.07 uh approved resolution of the Border trustees and I'm Mark Union Elementary School District that black lives matter um I believe was it trustee Quintero or trustee yeah uh both uh I and trust you don't have submitted this request and so um just want to thank the administration for moving forward and helping us bring this resolution forward and with that I'll hand it over to my colleague um what I said earlier that unfortunately white supremacy is relevant um I don't know if any of you guys read the mercury news today um but there was an article um and I just want to highlight one of the um quotes on there um of uh Dr Scott Myers Lipton a professor at San Jose State

351University um and really you know uh he highlighted how it is a call to every one of us in the Santa Clara County he said to examine our policies our attitudes our culture to ensure that black lives matter and to develop develop specific plans to end white supremacy in institutions that we are connected to um and I just think those you know words are powerful and important um and you know unfortunately some of us even though we're not white sometimes you know we fall into that uh that mold um without you know wanting to but uh for whatever reason um and so we get to shake things up and we get to you know look again you know um look in those areas that we get to be better in um and you know it

352was uh quite clear to me last you know at last meeting um that we needed you know we needed a little bit of shake up and you know it's bringing at the Forefront and to really stand as a leader you know I I thank you Andres Quintero um for go um sponsoring this um and we get we get to be vocal and we get to act what we say I mean who we are um and I am one of five right um there are five of us and we all come in with our different you know shapes forms and um thinking um and I respect you know people's thinking and thinking differently um but as one of the five you know I get to make sure that what what's important gets put in writing um

353so yeah that's it um I'd like to call uh to move to approve this uh resolution okay there's a motion on the floor is there a second second president Marquez with the second okay do we I'm assuming we have public comment Mr Gill and Mr Sanchez I don't have any in via email okay Mr Gill yes we do have two Veronica Veronica I'm sorry can you repeat that after the last name is Tad tone um two Veronicas one is Veronica alone and Veronica what is which one is the first one um Veronica okay Veronica without a last name visible um your looks like you're unmuted so when you begin speaking your two minutes will begin great uh again my name is Veronica I'm the mother of two Island Rock um students and I also very

354much support this memorandum that trustee Lo Etta and Jose pintero has brought up right and I just want to Echo Presley um sorry uh yes Laura um on those white supremacy right and taking that privilege that sometimes that white privilege and like what we fall on right um and we can't just sign this and be like oh cool we're past it and we're so great because we're not right we need to defund the police and that's something that black lives matter actually stands with um you are defunding the police when you're citing this and if you are not then please do not sign it do not put your name in there right it will be a disgrace just straight up sell us I do not stand with black lives matters as do you have especially

355your president uh we ask for your resignation again um that if you are not standing with the community and with black lives matter do not sign it we're asking that that memorandum is not just a paper it's an action right and that in in that action we're asking that we invest in our children we invest in their well-being and we do not invest in the police being in our schools no matter what again do not sign it if you don't stand with it don't act like you want to be like the city council in the city council chair because you will not be simply you will not right truth is coming out to light and we are not tolerating your behavior so it has yours um President we ask for your resignation we are not

356tolerating that anymore you cannot oppress us anymore we are here and we are here to stay and we are here to speak up you cannot just mute us to a one minute anymore thank you next speaker Veronica I didn't get the last name but Veronica with the last name that I didn't get um when your microphone is unmuted uh your two minutes will begin when you begin speaking so the second person is Veronica if I pronounce this right I don't see her on my screen good evening my name is Veronica Talton and I'm in Alan Brock employee I'm an African-American educator and I'm a proud area member I spoke last board meeting which was June 11th about this and I want to publicly thank our local president Jocelyn Mertz for being extremely supportive of this

357I'm also a member of the area Equity human and civil rights committee on June 11th we asked two things and we asked that we be put on the July 9th meeting to bring forth a resolution for black lives matter and we also ask to be a part of the discussion when a racial Justice task force was formed I want to publicly thank and acknowledge trustee loera for stating on June 11th that black lives matter I want to thank those who have worked on a resolution for this meeting but I would like to acknowledge that the area equity in human and civil rights committee wishes to have a seat at the table and work alongside the board and any other staff members who wish to bring about positive change in this District I am proud to

358be an Alum Rock employee and I am proud to be African-American but I had no intention of speaking tonight that I had to say thank you to the Allies who keep saying black lives matter well for me as an African-American it means a lot a lot more I cannot take my skin off and I have been marginalized my entire life and for those who have stood with us to say black lives matter and did it way back in 2013 when the hashtag started and who will continue to stand with us I thank you and I thank whoever put the black lives matter caps on the website what we are hoping to do more and to do more for the students and the community thank you so much thank you is there any other comments Mr

359Gill yeah there are two okay who's the next one famous in the house when your microphone is unmuted um you have two minutes when you begin speaking hi I just want to thank you guys for putting this on the agenda I think that it's really important to make a statement and with our community in this this is a crucial time and I think that we all need to show a support so I want to thank Karina Herrera and Kim Taro for bringing this resolution um it means a lot to me because I do stand with my community and black lives matter and I will continue to say that regardless if the media or anyone is not speaking on it we will keep shedding light because it's not over until we truly do things that change

360uh the systemic racism that has been created around them and until that is solved we will continue to push for them to have equal rights and not only that I do wish to uh also ask that when you do that include parents as well in this committee because we also want to be a part of this and make sure that this this isn't just a resolution but it's it's a step to change and with that means defunding the police and really writing it and you guys taking a statement and agreeing that you all are here to defund the police um and I mean that by meaning you reinvest in your kids education we have to create leaders we got to make sure that our kids know that we believe in them and the only way

361you will do that is by reinvesting the money in our kids not making them walk to field trips not making them sell chocolates for a science camp we really need to invest in our kids I appreciate this resolution I want to see more change this is a big step thank you thank you is there any more Mr Gill I think you said yeah the last one Victor Vasquez okay Mr Vazquez when you are unmuted your two minutes begin when you begin speaking hello um my name is Victor Vasquez and yes last uh we work with also a coalition of organizations Grill Migos de Guadalupe we also work with the Mexican heritage plus of evolution of course almost Mayfair Under the Sea Supply Collective Banner we have decided as well to put our own resolution a

362while back in our own statement on this because we understand that the grief and the rage that it feels we have our own local families here Latino African-American Asian who have also been impacted by police violence we all understand that we're also impacted by racism and right now is the time to also Center the voices and the ask of black or black community members so we put our statement because we we want to be in solidarity and we completely support the request to include the voices of black Educators black families in the curriculum and the equity uh development conversations as well we stand with you and and also to our area teachers we would love to continue to work with you closely hand in hand to continue to advance racial equity and economic Justice in

363The District in our city thank you thank you are there any more Avatar or is that it is nice what was that yeah no more okay um I saw your hand and then trusty Chavez after that um so actually I wanted to um amend the resolution um if uh possible and Rogelio let us let me know if um it is but if we can include it therefore at the end um and then just uh take care of this now um therefore be it resolved that arusd terminates contract with sjpd and that arus ESD no longer retains sjpd or any District hired police officers such as sros uh now or in the future can we add that Rogelio is that possible if uh uh yeah I'm looking at the agenda language um yeah I think that's

364possible okay trust me so is that that's an amended motion correct yeah Andres do you uh accept foreign are the ramifications of the addition of the language if let's say we were to have a crisis and uh we need to go ahead and bring on extra support because we're being threatened or something like that what um what uh I I know that in the past we we had a situation where somebody made death threats to through Twitter and um we had parents who were police officers who came and were standing around and lending support but if we were to face a situation like that would we be prohibited from um getting extra security and support for our schools through this resolution is it is does it limit us completely from being able to at all

365under any circumstances bring in extra support to protect our kids so so that so excuse me so that's a that is a really good question um in emergency circumstances or under pressing circumstances the district just like any other private citizen or company or organization always has the option of calling 911 or asking for a police drive-by and those types of circumstances the question is more or as I view the question it's more do you have events where you commonly require some security presence whether it's San Jose PD or some somebody else and yes this would potentially affect that because this is a you know determination by the board not to contract for those services so I I just don't know what the scope of those types of services would be whether or not the maybe

366the superintendent can chime in but whether you have events where you you typically are normally contract for Security Services all right well um thank you for that clarification um if it's the intention of the board to rely solely on on 9-1-1 or emergency situations and I guess you know go for it and then we'll see where where the board majority falls on this uh so yeah I'll go ahead and afford it I did see I see you trustee Chavez but I did see um potentially as a response to mystery Ruiz Dr Bauer looked like you might be saying something and then trustee Chavez um we can go to you after that just really quick remind everybody of the time that we said that until 11 30 and it's already uh 11. yes thank you uh

367superintendent Bauer were you did you have something to add to that it was very much what Rogelio said in terms like we can always call 9-1-1 if there is an emergency I mean I that's just gonna happen um I just don't think that um this will have any specific ramification unless um there is a little Clause the the extra uh kind of what Rogelio says is when we have kind of end of the Year celebrations like graduation ceremonies where we are you know required the other one is the Cesar Chavez March because they provide extra support when we are when the kids are walking in the street um those are the officers that help control the crowd and make sure the kids are safe but you know having said that we can certainly work with

368with our parents and um um I'll volunteer too yeah so I I just wanted the board to to be able to know that I I don't see any significant ramification from our perspective of administering safety to the kids to a question Mr Reese just um to clarify because I believe you know if we do move forward with this I do want to make sure that in the future you know there's not a situation that does come back to to hurt us and so for instance in the Cesar Chavez um example that Dr Barr brought up where we typically do have um assistance from officers to just kind of guide that um and I assume that we would be able to easily get volunt parent volunteers to do that but are there I mean off the

369top of your head in this moment can you think of instances where our not providing that on-site preventive kind of um support wouldn't would end up putting us into a position of liability for anything that might occur so the the District of course you know has a has a responsibility for providing a safe learning environment and a safe environment at all of its campuses um so I think the answer to that is generally no I don't think it adds any increased liability to or exposure to liability given the nature and scope of your normal operations I mean the Cesar Chavez parade might present I I'm not sure whether the city issues a permit to the district to allow for the parade and a condition to the permit is that uh the district or um police

370support to help guide traffic and and keep the kids safe I would view that as a different circumstance because that's required by the city as part of the parade permit but I'm not sure that you pull a parade from permit for that um but from a liability standpoint given the scope of your operations I don't you know I I don't see that it generally comes up like with high school districts where commencements are held in in other facilities and they tend to be very large with maybe a couple of thousand people there um but your your eighth grade uh uh ceremonies are typically held at your school sites so that's that's different as well okay trustee Marcus I don't know if I heard you trying to speak I'm not sure I heard something I was

371clearing my throat okay it's about that time or the night when I start cleaning the throat okay um I would you know just to speak to a couple of items I um you know in my in my opinion I I do not think that the provision of safety from ex potential external threats is mutually exclusive to me sitting here and state that I support black lives matter I I know people have very different opinions but I I feel a strong obligation to do the you know the best that I think that I can do for you know that obligation that I mentioned about providing Safety and Security and I think there is at least room for discussion and consideration about how that might look different um with a with an educated and trained law enforcement

372presence I mean I just disagree and I I guarantee you it's not easy for me to stand to sit here and stand behind my convictions about how I feel about this but I do not I would disagree with the individual are individuals who think that those things are mutually exclusive and that they speak to my commitment to Black lives matter in this moment but just advocacy for African-American black African ancestry families in general my history of doing that of you know standing shoulder to shoulder with with you know my African-American brothers and sisters doesn't span the past 25 days or 25 weeks or months I've I've as was alluded to I have worked professionally for the past 25 years and done and and advocated for my fellow African-American Community communities in a way that sometimes

373has cost me professionally for speaking up and saying things in rooms where it was uncomfortable and not easy to say things in advocacy of um of my African-American brothers and sisters and so so you know black lives matter is the term that we're using now and I certainly am solid I'm in solidarity with that um because I have been my entire career so I think in my estimation it is unfair to characterize something differently of course everyone is open to their opinion and I respect that um and so with the amended uh resolution I would support that resolution um because in my in my estimation the my my feelings and opinions and thoughts about the importance of advocating for for black individuals and black families particularly in this moment but obviously a long history past

374is stronger than my um my thoughts about what we need to do to provide Safety and Security in our schools um you know so I would I would support the resolution as amended um you know I do think that we lose an opportunity to to find a real um a positive way going forward to work with with Community Partners but you know as I mentioned I believe that I believe strongly enough that black lives matter is important is of such importance that it outweighs my other feelings particularly since I've been reassured by our legal counsel and staff that that we would um we would not potentially incur some liability or some added thing that we can't foresee right now going forward so I would approve or I would um personally approve and support the resolution

375as amended any other questions or comments give me give me the amended version one more time um therefore be it resolved that a-r-u-e-s-d terminates contracts with sjpd and that aruesd no longer retains sjpd for any District hired police officers such as sros now or in the future have a quick question so the only way that you can have uh say Cesar Chavez parade is um by having the police officers there so does that get canceled on because the city won't allow it or how does that gonna work I mean um for the resolution and if we if we need to uh cancel the Cesar Chavez which is what happened this covet it got canceled do we need to do that or start thinking it in those terms you know that's why I said trustee Chavez

376that we can deal with that as any other field trip and that's when I mentioned the word that I was looking for was chaperones right we're gonna have parent chaperones or chaperones to help us with the kids I'm sorry because my internet keeps going in and out so that's why I had to ask again no that's fine that I understand thank you I want to be very clear with everybody that that's the way we will handle something like the Cesar Chavez that's just one I mean there's other events Quintero uh look the way I first used it I I am you can see from my line of questioning that I'm concerned about a blanket uh statement but I'm also cognizant of the fact that if some statement that we made right now is going to

377get in the way of us recognizing uh and having our kids engaged in things like sister Travis we can always take it back up as a board and um for example I'm not and this is an attack or anything but I'm not comfortable in having our kids being looked after by volunteers or chaperones instead the expectation is that we will do what it's required to keep the kids safe as they're making their way through so if we need to revisit uh for this specific event or whatever I'm sure we as a board can go ahead and take that action and make sure that we're not because of um this action today we're going to be stopped from engaging in a um in a celebration or something significant so um I don't I don't foresee that

378being a problem it's a it's a big enough deal um the board will revisit and say Hey you know this is going to wind up forbidding the kids from engaging in this big celebration we can take care of it later another quick question uh Ruiz that just popped into my mind um so in terms of like things that are not necessarily an emergency and I'm just trying to play this out like in for instance enforcing um a restraining order you know that's been a reality in our district and and things of that nature that um I guess then am I to assume that we would call 3-1-1 um for something like that or you would just resort to the normal process for engaging the police if you have a if you have a security or

379you know or a danger issue at your campus which is the staff would call 9-1-1 or they would call 3-1-1 and ask for support at the site president it's 11 20 I would suggest that if we're going to move we move on this and then we try to get to whatever's time sensitive in the balance of the agenda remember that we don't we can't yes okay so does anyone feel they need to say anything urgent like in 10 seconds if not we can call for the vote on this okay so we will call uh we'll go ahead and call for the vote on this we had we did do public comment right yes we did do public comments so we'll call for the role called vote Tres D Chavez okay trustee Marquez aye trustee Quintero

380and myself I the motion passes unanimously um Mr Ruiz what is remaining on our agenda that needs to occur this evening uh well I would uh I you know I'm not sure what the superintendent has in mind but the lcap operations report is time sensitive it has to be approved before July 1st Okay calendar because it's got all of our things that we need to do oh move approval it's not it's not a consent according to Mike did you move it into it which one which one are you referring to you 803 yes 803 no amount of approval okay there's a motion in a second to approve item 8.03 lcap operations report is there any questions or comments from the board on this item can because 8.03 doesn't say oh okay but it just said

381that we can take action yes so no question okay I'm assuming none um so is there public comment on this item Avatar or Mr Sanchez so there are two hands raised not sure for this item or the one from before okay well right now we're taking public comment on this item 8.03 lcap operations we did take public comment on the previous item and we have eight minutes so I'm gonna go ahead and um in the interest of time I need to limit these to one minute public comment in order to get to our consent calendar um so is there any objection to that from and we we really need 802 please that's the other one that it must that must be approved today okay sorry so since we already have a motion in a second

382for 803 is there a public comment for 8.03 do we have hands raised for that I mean Mr Gill yes there is only one floor okay Miss de Leon um once we have the clock up and once your microphone is unmuted um unfortunately because of time as I mentioned we have one minute so Maribel once you get the clock up I think Miss de Leon is on yeah she's unmuted Mr Verano we have a little technical challenge for bringing the clock okay um de Leon um go ahead and get started and I will I'll have to do a manual count for a minute um I apologize for the inconvenience unfortune that I that uh we're we are not giving up their um enough time to for people to and for you guys to understand this

383item because this item talks about the L cup and I I don't know if you even know what you're gonna be um approving but this one um it talks a lot about the um the program that is called um supplemental estate funds which um for students would seek to act you you will understand it as Essa and this one will talk a lot about the programs Effectiveness instructional language instructions for students and the previous proficiency and that support for that their academics and we're not given enough time for that you know it's just really frustrating that you even wasted the time to do a presentation on your own and I'm also part of the oversight committee and we have the members for the oversight committee to be presenting um and you guys are choosing what

384to present you know and this is so late and ridiculous you know that you guys shouldn't spend more time on this because this has to do with that learning and the instructional and the things that we need to talk about for our kids so it's very disrespectful that you guys only give one minute and that you guys are just talking talking talking talking about other things that yes they are important but please next time pay attention the outcome when we're talking about outcome I want the item to be at the beginning of the meeting thank you um did you say we have one more Mr Gill yes we have Veronica okay Veronica when your microphone is unmuted um you I'll do a manual count and you'll have one minute to comment on 8.03 again uh

385I don't know good night everyone um my name is Veronica I'm the parent of two Alum Rock students and I just want to Echo what floor said um it is very important that we put lcap at the top of the agenda um it should not be something that we are timing it with such little time right again I don't think anybody really knows what they're voting on and this is where the funds get misplaced right this is where the funds go into Pockets that they shouldn't be going to um and it's it's sad it's sad that we had to be lectured by you as we ask for your resignation um it was just sad that we had to also apply to your documentation that was from Facebook not even real sources but we can't even

386have their actual presentation for lcap on this item I'm very sad as it comes to twins as a boater and just really hoping we can do better because I know we can do better we are not going to make the same mistakes as we did just a few years ago I refuse to do that thank you okay um do we have any more Mr Gill one Maria Martinez okay and just a quick question Mr Ruiz in um the priority of passing these versus having to take public comment um is the priority on passing these time sensitive items I know we have to take public comment on each item yes yes uh the operations report has to be approved before July 1st by law okay so um unfortunately because of that and we're down to three

387minutes we do um we have taken public comment and so we're going to have to take Miss Martinez's comment offline with that would that work for this instance to get that approved uh you can just ask for 30 seconds okay Miss Martinez can you get your comments in 30 seconds roughly I apologize for the um inconvenience 30 seconds yes okay of course uh High trust is uh I I'm so mad and I so disappointed in in with this item because you always approve the air cup and I I don't hear you uh nothing about the question um do you you know mention evaluation that you do it or what do you find that that's always or with the same and that's a very important document that's the money for our students so please check in

389wanted to talk regarding item um the outcome item I just I've said at this board that oh um it's the money budget that goes for 81 of our students um there are high needs students and for you to just delivery took this to the last minute and not paid nothing too little attention is a disgrace and it's not your job as a board members and you guys are doing a poor job for our students thank you and have a good night thank you okay I'll call for a roll call vote on this item trustee Chavez hi trustee Marquez and myself I motion passes unanimously is there a motion on the consent calendar motion to improve the consent calendar second option to approve in a second to approve the consent calendar is there any questions or

390comments from the board okay see none do we have any public comment on the item Mr Gill none okay so we'll call for the roll call vote trustee Chavez hi trustee Marquez I I trustee Quintero hi my uh and myself I motion passes unanimously um so the balance of the items oh Dr Bauer go ahead uh yeah and I want to thank the board I want to clarify for the community that you did not approve the l cap tonight this was not dial cup the l cap because of covid-19 has been moved that deadline for December I just want to be very clear that the board did not approve the budget for the El Cup tonight this is a report the first one that was approved if the operations report of what we did during

391covet 19. if you read the book that's what it says and then the addendum is just a recurring uh report that we had to send to the feds about Title One title two title three so Community the board takes this very seriously and I know you know I just want to be very clear that that was not approved tonight and that there will be plenty of time for the board to go through the l cap and go through the same process that we do always thank you thank you so the balance of the items tonight um there was a few that I think we did not get to what we can table to the next meeting correct okay I have a question go ahead um the presentation by the citizens oversight committee is just information

392so there's no formal action um is there the ability is there anybody who's going to present first of all secondly is there an ability to listen to that report even though it's already 11 30 and we're not able to to move forward uh officially in any sort of capacity but would we be able to just take in information um and would that violate the Run act if we were to listen to a report I'm not I can I can read I think I can respond to a little bit of that I'm not sure that it's a brown act issue so much as it is aboard bylaw issue about the conclusion of your meetings um so but there's nothing about there's nothing in the Ed code that requires that that report be delivered before July 1st

393like the other items that you just approved all right so we can table the remainder of the items until the next meeting correct I believe so okay so with that being said we will adjourn this meeting at 11 33 pm thank you everybody and we are adjourned thank you thank you everybody thank you thank you everyone thank you foreign
