be unmuted if we need to Dr Bauer I see your name Mr Moran here yeah Dr Bauer we can't hear yet can you hear me now we can hear you now so we have uh trusty Quintero are you still here right here okay looks like we have everybody here mister Mr after Gill it's Gil is here I just call you after all the time it's Mr Gill right or am I saying it wrong yeah uh first name is after last is kill Gil okay so Mr Guild um do we have everything set up in terms of the the rooms and the stream and the mutings and everything that we need as we planned for everything look like it's in place uh it is I just need one minute let me mute you we are we

are seeing uh facing little bit of the uh um yeah a little bit of the echo okay okay so while he's working on that um this is the meeting's not started yet so unofficially I'll just remind everyone that particularly bored and potentially staff we are all this is currently to my understanding live we're on um you know we're being recorded right now through video and audio so this is all live right now I also wanted to remind all of us um trustees or really I guess anybody who's participating tonight that particularly board and staff if you need to just as we would in a regular meeting if you need to get up to use a restroom or get something to drink or stretch your legs or whatever please feel free um I may get up

and have a little drink for me uh ready to go but in case I need to stretch my legs and I may stand up um there's some other stuff I'll say once we get started but those are pretty much the make sure that when you're trying to trustees I think all of our mics should be open all of the time it looks like a couple are not I don't know trustee Chavez and tries to keep that are you doing that on your own end yes yes okay so there's no problem with Mike so if you want you can have your mics open just as it would be in um a regular session but if you want it muted if that helps you that's okay too um trying to think if there's any Mr Ruiz is

there any not the specific stuff that I'll get to once we get started but any other just kind of housekeeping stuff you can think of or Dr Bauer no I think you covered everything so far okay yeah we're ready to start I think Mr Gill is working on the echo part of it um so let's just leave trustees uh trustee can you just say something and make sure there's no Echo for you foreign I think she's trying to unmute it or as any other trustee if you can say something while she's working on that interesting what's up yours sounds good trustee Quintero trustee Chavez it's working thank you sounds good no Echo uh Christy Marquez can you hear me she might be on the one with Mr Gill so she might not be able to

hear trustee no Echo there no Echo for Mr Ruiz so it looks like trusty Marquez and Dr Bauer are the ones that they're working on um are you in here can you hear is Maribel here and able to hear and talk thanks I can't hear you Mr Gill Marcus yesterday Marcus okay so um are we do you think we're pretty close Mr Gill so we want to do a test with trustee Marcus she wasn't able to hear you clearly okay so I'm saying a sentence right now and I'm finishing it right now can you hear me trusty Marquez very nice and clear now perfect okay [Music] do we think we're ready Mr Gill this is Sandra Garcia I just want to check that my voice is heard from my presentation later yeah you sound good

sounds good now um okay I think I think we should have everything so tonight uh my gavel is a hairbrush so I will be calling this meeting to order at 5 40 p.m um for our let me just bring it up here a regular board meeting for the month of April 2020. um let me just get everything lined up here sorry so before we do anything can we have Maribel please take the role today is a regular board meeting of April 19th at 5 30 and members of the board of attendance here vice president Quintero here remember Linda Chavez president member Dolores Marquez muted members of administration superintendent Dr Bauer president okay thank you so we do have a quorum this evening um one other thing we will do so similar to the special meeting

that we had recently we will do our Pledge of Allegiance however because of this situation if you are able to and can and want to you can stand for the purposes of this I'll remain seated but I will lead the Pledge of Allegiance at this time so um we can get started with that I pledge allegiance to the flag the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and judgments for all thank you everyone okay so now before we get into the actual agenda I just want to um first of all thank everybody who's participating this evening and who's watching after the fact for being patient with us as we all know we are in a historically um challenging time in

many ways and certainly for to in order to try to run this meeting there are many challenges that we've been dealing with recently and you saw some of them here we started about 10 minutes late but I want everyone to know that first of all we have an amazing staff Mr gilm the superintendent all the rest of the staff our legal counsel have been working 24 hours it seems like behind the scenes to make sure we get everything lined up and in place so um so we are trying to do this in a way that is very transparent and very accessible for our community so as many of you or most of you probably know there is um a live stream of the and Mr Gill if I mess up on this please feel free

to correct me at any time but we are live streaming this video on our YouTube channel which um is Alum Rock TV so if you go to YouTube If you're not there already you can see the live stream of that um there is also a Spanish live stream that we have available and all of this information is in the agenda that you can if you don't have it already you can find it on the district website um so there's the Spanish stream there's the English stream on YouTube and then there are multiple ways that you can participate during public comment in this meeting so if you can see I don't know how to point here but behind me on my screen um hopefully you can read it but if not this is the same information

that also is on your agenda but if you would like to provide public comment on any item on the agenda tonight there are multiple ways you can do that you can email that comment to public comment at arusd.org you can text a comment to 408-963-0058 you can call in and you will be heard similar to how trustee Marquez is being heard tonight you can call in that phone number is 712-770-4598 and you'll need a code which is 428-303 if you are utilizing any of those methods to provide public comment please let us know the item number that your comment is for that'll help us make sure that we get um comments at the appropriate times there is a bit of a delay on the YouTube stream so we're going to do our best to try

to manage the the comments and make sure it goes with the item on the agenda again we're doing our best hopefully things will run smoothly and we'll do our best to ensure that they do the last way that you can provide public comment is um I see some callers I believe on my screen that may be Zoom callers that are calling in through the zoom platform so in order to make a comment through Zoom directly you can use the raise hand function in zoom and that will allow you to Mr Gill will see your comment and he will um um contact you to let you know you'll be giving comment and then when it is time for your comment you'll be able to provide that comment um Mr Giller Mr Ruiz or superintendent Bauer is

there anything I missed with regards to those specifics no and is there anything else of the the general stuff not specific to public comment that we had said that we were gonna Mr Gill is uh trustee Marcus she got disconnected from the phone line I am bringing her back into the line she's currently not on okay or we can hopefully we can keep her connected um but for now we we do have a quorum so we can move forward did someone is there someone's microphone open that has um maybe their children doing homework or something because we can hear that interesting can you hear me yes uh so a couple things um there's a parent Spanish-speaking parent that texts me that said that the Spanish-speaking YouTube is not working so I'm not sure double check

that um and then maybe uh requesting everybody to be muted unless you call them or something us um everyone so you can mute yourself I I wanted to make sure I wanted to have everyone's microphone open just um you know so people could feel free to comment as it would in a normal meeting but if you want to and if you have background noise going on it probably would be a good idea it seems like everyone has their own independent ability to mute themselves so um so on our end I think we won't mute You by default you'll be open by default but certainly if you feel the need or want to um mute yourself you can do that just remember to unmute yourself when you have something to say I was just talking about

anybody else at their house that have children I'm by myself in my room but those should be muted uh the only people that should have open mics are staff and and trustees so if there are staff and trustees that have children or something running around then that would be a good idea please and thank you um okay so I think at this point with all of those formalities out of the way we can actually um start the the formal meeting and I also Okay so we will begin with item 1.02 discussion and or modifications of the agenda I didn't receive anything from the public does anyone else have any modifications to the agenda I don't know who is speaking that's trust me Marcus oh okay did you have a modification trustee Marquez before we go

into that um I was not connected with you I just came on on a different number so I don't know um what formalities you guys were putting together because I was not connected um yeah it was we were just talking about you know the challenge actually that's a perfect example we were just talking about the challenges that we may confront tonight with the technology and we're you know we've done our best to try to make this very transparent and accessible to the public and everybody but we um we're hoping that we don't have any further challenges but we expect that there may be something and we just ask for people's patience and understanding um and and you know we I also Express gratitude to our staff that's been working really hard to to put this

together so that's what you in a nutshell I think that's what you missed yeah and that's okay did you have any modifications to the agenda no I don't okay so I I don't hear any but I do have one um item 12.01 future board agenda request um we're gonna move that up to after this item just because at the end of this meeting we'll be going into closed session in a completely different Zoom room so trustees hopefully all of you got that information that I emailed with the closed session Zoom information so we will um we we're gonna move any any of that item up to the front so that people don't have to wait and then log back into another Zoom room just to make a suggestion to um to add an addition add

an item for a future agenda sorry I have a question something during the meeting um as it progresses that later on you have a future uh request is it only limited to in the beginning and we can't add it towards the end um Mr Ruiz if we move that item before we actually end the meeting to go into close or before we recess to closed session can we re-ask to see if anyone has had a an item that they want to add yeah I don't see a problem with that because it's not an action item anyway and per your board bylaws every board member is authorized to ask for an agenda item at any time so no I don't see a problem with that okay perfect does that answer your question trustee Chavez yes it

does thank you all right um so nothing else okay the other the other thing just in terms of moving the agenda and moving the meeting along I forgot to mention but it is important that um because of the the governor's um things that he's put out the the resolution and things that he's put out there is a um we do need to try our best to to really keep this meeting moving along and and and make it as um as brief and efficient as possible because once we are done with the meeting our District staff needs to go into the offices at the district office where we have several people right now and they need to do a full deep cleaning of those rooms um so that would mean you know depending on what time

we end District staff could be here well past midnight potentially so we we're going to do our best to try to keep things moving and and expedite the the meeting um so that's that okay so if there's nothing else for item 1.02 we can move forward to item 2.01 request to address the board on any items that are not um on tonight's agenda um oh and also before we move Mr Gill did you hear the comment from trustee Herrera Loretta that apparently there was some challenges with the Spanish-speaking stream on YouTube um so you don't need to answer but just for your knowledge I'm just wondering if maybe somebody can test it within our staff who can you know check and see if it's um yeah yeah if we can um look into that Mr

Gill because we did get a message from a parent that the the Spanish-speaking YouTube was having some kind of problems it wasn't visible or audible or maybe both I'm not sure um yeah I will check that in the meantime thank you okay so let me turn off my ring so um are there did we have we received any email or text or any indication that there are comments um on items that are not on the agenda tonight and I I guess that was the question for Mr Gill but Dr Boward are you aware of any um comments that we receive for non-agendized items who knows that there's only people who want to talk to the turn limit item that's what we have okay and can you confirm Mr Gill we have no other non-agendized items

for public comment is that accurate yeah there's accurate okay thank you so we will move on and I'm sorry I sent a text uh to the number that you left 96300 oh uh after are we able to monitor or or control the it sounds like people have access to open up their mics that are not bored or but that's good because I was I sent a text whoever's speaking can we just hold on for a second I just want to make sure we have Clarity on our how we have this set up thank you again thank you everyone for your patience it's just part of the challenges of making sure we set this up right it should be good now okay so the person whoever was speaking if you can try to talk now just

so we can make sure that you don't have that ability okay can you hear me we still can't oh that's floor yeah so okay hold on a second please okay thank you okay can you do can you talk now miss de Leon can you say anything okay sounds like okay so um it sounds like maybe she does she might have a comment for the non-agendized items so Mr Gill if we can now unmute her and give her that opportunity opportunity and just to be clear while we're doing that for everybody that's watching the reason why we are um doing this is very has to be very um cautious in the way that we protect the public from anybody who may try to come on and and say or or show things that would be inappropriate

Mr Gill is monitoring that and so we really that's why everyone that's in here does not have the default ability to speak or have their screen scene because we're we're not we're making sure that that's appropriate for our community and also just another reminder sorry before we get to this comment if Jordan if anyone is watching this and they come on here who has a name that displays as inappropriate that will also be automatically um ejected from the room so we were trying to keep everything appropriate so that this can be watched by the community so miss de Leon did you have a comment on a non-agendized item yes can you hear me yes so you do we have a timer already I don't see the timer but I don't know if it's like in

the city hall you normally see the timer yourself but I don't see it yeah hold on I don't I don't know that's one thing I don't know that we have um we don't have that correct staff at a way to if someone can post it on their own the timer with the phone that will help too do you have the text on it Mr Gill do you have the ability to share your screen and just pull up a timer from the internet okay let me let me just let you know president email in the tech where Sanchez has received he's the one managing it all of them have to do with term limits okay so when we get to that item but um I couldn't hear you because you were muted after do you have

the ability to um share your screen and share a timer so that the viewing public when they're making their comments can see a timer or is that not possible yeah so I have a about 30 40 people on this Zone session So currently I think it is my limitation however I have a phone handy so I can start a timer on the phone that'd be okay um that will be okay but it will be helpful if you put her closer so I can see it too but I just want to be clear that you guys gave the option to send texts and I sent three text messages so I don't know if someone is receiving those text messages because you get different options to comments so that should be something that you guys need to

look into a lot of people like uh it's committing for turn limits like I'm I'm commenting right now I'm probably coming number can you see my my screen yeah I see it okay so let's let's try to use this one and see if I can manage this okay are you ready yeah okay so we'll go ahead and start okay so thank you very much for allowing me to attack you know I wanted to talk about uh in kotolo that we're going through with the closing the schools the way the kids are learning now you know it's been very confusing now we're almost at four weeks and it's been very confusing on how what direction to go and I know it's not only with our district I have seen how other districts are are working but

one of the concerns for talking to people because we talked to uh parents and one of the concerns that I um that I see people has is like for parents that don't speak the language that they don't know how to handle the computers and also like sometimes they they wear visiting campuses and there was no one to give directions to where to get the computer so I think just to suggest something that I think you will be very helpful is to be able to have a certain times just like the way you guys are eating lunch a certain time in the Schools staff that can be able to to give that um that resource to the people and if you're not from that school at least to communicate with other stuff that is is taking

over to be able to address that the necessities of these parents and the necessities of the kids that need to have their homework because some kids you know that don't have the access to the internet and I know it's it's not easy it's hard but I think it will be good to have a personal in the schools that can can really work and support those families those people and just for to making sure that our kids get their homework and and we're not letting anyone behind so uh and I know that you guys are getting to a very Direction now because it's already like I say a month and now we're more clear that we and we need a plan and a long term because we already know that the schools are going to be

closing for the rest foreign okay are we back regular [Music] um can you see my regular screen or the timer okay good okay any other um comments on items that are not agendized this evening um so can we um Mr Gill can we unmute Miss Jamal um the name that we're looking for here I know you're looking at a whole bunch of screen okay I we saw a raised thumb on screen is that is that we're using the function of Rey's hand for um wanting to provide public comment yes okay I'm sorry this sorry sorry is this a non-agendized item yes so let me just get this timer up for you then thank you for your patience does everybody see the timer no I don't see the timer sorry yeah I do okay you ready

okay we can begin um hi I just wanted to give a comment it was really hard to get in this room um I would like it to be more accessible I didn't see it on the Facebook Ellen Rock Page um for the public to actually be able to log in I'm watching you guys on the YouTube live but I would love for it to be a little bit more transparent for the public um and then I also want to thank everybody that's working because I know this has been very difficult for everybody um technology is not I I our district strength right now but um I think that we can learn from a lot of the other board meetings that um I've been logging into um I also want to say something to all the

teachers and I want to personally thank my son's teacher Miss Fellaini and Mr Mitchell who have been on top of my kids being on logging online if they have organized themselves so well where they have sessions with all the kids and they're making sure that everybody has their Electronics however there has been an issue with language a lot of parents are still not logging in because they don't understand how to do it if we can provide maybe a YouTube link or something in Spanish so we can share to maybe all schools because there's still a lot of kids that are not logging in class session yet today alone was uh 20 students logged in my son's class and it's 35. so those are kids that either don't have a device or I don't have someone

to support them on how to open a zoom account or anything I just wanted to say that um thank you guys okay I think the comment might be done I kind of cut out there hello Brenda are you there still I know okay so I think sounded like she was coming to the end of her comment anyway it kind of cut out but in any event timer also ended so thank you for that comment um after do you have any indication that there's any texts or emails further for this item maybe one second Mr Sanchez he's looking okay okay um and in the meantime can I request staff to explore a couple things the possibility [Music] um if we didn't announce the meeting this meeting through our social media sites to do that for the

next meeting um I thought there was another thing but that that one for sure if we could just explore um oh and also if we could explore the possibility [Music] of uh some type of training for um for the accessibility with devices for extenders this is a conversation with Pro we have I just wanted to um I think that request based on some of what I've heard is that okay at this time Mr Ruiz he's a brief like that okay good um so no nothing Mr Gill further comments okay excellent okay thank you public for your comments just received one you received one okay [Music] do you have it there ready uh Mr Gill excuse me [Laughter] did I see you did I see an elbow there I'm old school sometimes I still have to

I have to learn the elbow Mr Vasquez is is that you no this is Rene Sanchez saying Victor Vasquez wants to make a comment is it a text or are they on in the zoom wanting to comment I believe it's on the zoom but um a [Music] Vasquez in the zoom [Music] so Mr Vasquez if you are hearing this and you are wanting to make a comment s you said it's from Victor Vasquez okay so I do see him so while Avatar begins unmute the mic let me um this won't take long um I just want to make sure that I really appreciated you all providing translation opportunities I have not seen counting your city actually think about translation interpretation like the way I want us to I want to uplift that and thank you

for that and also continuing to do so um error um but I I would like for us to continue to explore that translation because it's vital for the parents one of the places where you could really see parent engagement continue to thrive and again I've been we've been in County meetings as well city meetings and that's not a priority so I want to thank you for that let's continue to provide that translation in Spanish thank you so Mr Gill um I know where most of us or many of us are familiar with Mr Vazquez but um can we make sure that also any public cameras are are not visible um like I said we're familiar with Mr Vazquez so we know we're all good there but we don't know who else I want to make

sure we uh just a comment that the YouTube channel is functional we verified it is working so the reason might be that the link the end user might not be putting the correct link is okay so maybe a few people can check on that from from the district and make sure that that is functional if not if there's a way that we someone can share their screen um [Music] have the correct link agenda is that accurate yeah okay it looks like the link got sent to everybody um so if there are any community members in the zoom room you have the ability to share that out um we would appreciate it first thank you I believe it looks like you were the one that shared that so um District staff if there's a way that

we can make it more public um we can do that too but at least we know it's working I think our community will do a good job so we'll move on then to item 3.01 did you have a question or comment we can't hear you she's muted oh after his do you ever muted um so I've tried the link several times and it's not working but I know we're doing our best can you can you check the one that someone just sent in the chat room please thank you and while we do that is there a report from for item 3.01 a report back from kingsters [Music] they were going to try to connect but I don't see anybody I just wanted to tell everyone that we have been sharing the link with the person

that is having a hard time to connect so hopefully it will be okay now okay okay so we'll assume there is no comment from Teamsters do we have a representative foreign [Laughter] actually to you Dr Bauer on these if that's okay thank you Mr Moran for checking on the link I see you did that so is CSEA I'm assuming there's no one here for that Dr brown bear with me that they won't be able to join I don't see them either and just to let you know the person that was having a hard time connecting in Spanish YouTube is now connected is working um hopefully people that gets disseminated out what we are obligated to do is is um the Spanish version we're doing everything we can to get that going too administrators Association do

we have a Representatives okay um also accurate for area there no comments okay Jocelyn um foreign and I will do my best to keep this short um I hope that all of you are doing well and obviously we're light years away from where we were at the last regular board meeting in March seriously there's days when I feel like I'm in the living The Twilight Zone but this is the new reality at least for now um I would like to start by acknowledging all of our CSEA workers and Teamsters who are working on the front lines in our district to make sure that our students get fed and I want to thank the I.T department for providing the devices and keeping things running on the technology side particularly things like this Zoom meeting um and

thanks to the administrators who are who are also pitching in to help with the transition from our regular routines who's handling the legal requirements and meeting the needs of our special ed students along with answering my many phone calls and questions that I've had for him I also want to give a shout out to the district's bargaining team in the area bargaining team who had the extremely difficult task of coming to a memorandum of understanding regarding the terms of navigating our way to this new place in time and new way of providing Educational Services for our students I want to thank you to this school board for adopting the resolution of the special board meeting to give your support and confidence behind Dr Bauer who I have no doubt has had no rest during this

time either mentally emotionally or physically and hopefully you don't will have time to relax and rejuvenate next week during spring break you've done a remarkable job of hearing the voices of all of the stakeholders and building a plan based on a constantly changing information that it changes many are not only providing instruction to their students but are tasked with teaching their own children at the same time in their homes please just as we are sensitive to the individual needs of our students I ask that you be flexible and sensitive to the needs of our teachers as well and to all of our District employees is the right thing to do for Humanity at this time and we are all doing our best to make it meaningful not only on the educational level but also on

an emotional level by minimizing the stress on everyone depending on how many jobs you may hold or how many children you may have this gives us a whole new meaning to the saying that it takes a village I just want everybody to stay healthy and look forward to having a board meeting in person again someday thank you have anything briefly or nothing tonight colleagues um trustees do you have any comments if you do you can raise your hand you can speak up are we meeting her Avatar or she so after if we can um by default if it's possible unmute all of the trustees and then if they want to mute themselves I think that's possible but if not it looks like you're in music just want to um thank everybody again in addition to

everything that's been said you know remember to be patient with one another you know um you know Avatar you're doing great um Dr Bauer thank you for um for us to even be on this call and I hope to um you know just want to briefly say that because I really wanted to um mention to make sure that we take care of one another you know um and be patient with ourselves I appreciate the comments from parents earlier and I just want to remind everyone that we're all doing our best you know a lot um and yeah I'll just call anyone I'll call everyone trusty Quintero would would you like to add anything tonight I would like to um also express our employees that are um you know are there putting in the work to

make sure that our kids are fed um no I really appreciate the fact that um we've done a good job here at the District staff we've been able to figure out how to walk that fine line of providing access while still maintaining the safe space for our public to be able to come and see a meeting without having to be subjected to a bunch of uh racial empathize or or um or other things that have been taking place at other meetings so thank you for keeping our meetings a safe space okay thank you trustee Chavez do you have comments tonight and you are muted right now I don't know if that's you or after do you have trustee Chavez muted I just wanted to say thank you and I'll make it short and sweet Graces

um and thank you all the staff thank you we can hear you okay I think my colleagues said everything and all the thanks to the staff um there is something that I wanted to talk to um talk about it was to us from a lady um what is her name in regards to the future Garden that they have that they have been having for the last three years and she's requesting that if the district could at least fund them for 800 for doing this again for this year together foreign at this point we shouldn't be bringing people together and doing the hard doing the planting and all of the things that we do is all the things that they've grown um yeah um thank you for your letter and your concern and for working with

our community and our parents foreign [Music] I've attended everyone is basically as we know doing these Zoom meetings or some version of these meetings for different types of business and so I've been to a few um Zoom meetings with other uh board members across the county um it's a place where people are going other board members to kind of learn from each other and share what they're doing and their challenges and successes and so obviously everyone in our district is doing what they can for their District's particular needs which has been awesome to see but I also one thing that those meetings have have um really made clear to me put into perspective is you know some of the districts for instance are saying um providing maybe like a thousand meals a week or maybe

a thousand meals a day for their students which is awesome those families need that and that's what they mean but I know that our district um at least the last time I heard was between 2000 3 000 meals a day and so and I have spoken with some of our nutrition Staffing and just the logistics and trying to figure out how to pull that off every single day for our families it's just amazing so so it doesn't stop there it's you know it's as everyone has already mentioned it's the passing out the devices it's the developing overnight a new way to teach making sure that the structure and the system as best as possible is in place to allow teachers to teach to allow families to have meals to allow these meetings to happen and

Community too Community I mean I know myself and other board members have had Zoom meetings with community that have requested to provide feedback community in spite of whatever challenges we may have or have had I just continue to be amazed by what we are able to do [Music] thank you four point yeah 4.01 approved contract with springboard collaborative Intervention Program um after did we have any it sounds like we didn't have public comment on this program man okay and the other thing I I failed to mention earlier on um for each item what I'm going to try to do is I will ask for public comment up front so um if we got any emails or texts [Music] during the course of the the item may have something I'll ask one more time foreign [Music]

to provide a summer literacy Intervention Program for the kids [Music] um [Music] I did not get a chance um to have my one-on-one with Dr power so yeah yes I am thank you for the question trustee Marquez I'm sorry I'm sorry if you can whoever is talking can you can everybody here Dr Bauer talking clearly oh okay I'm sorry I guess it was on Miami too yeah response to the question so if everyone else can hear it might be on my end sorry Dr Bauer as well um I can hear you better now also Community I think says Community is saying that they can't hear and just let me walk is it being addressed Mr Gill I can't tell can you hear me better now much better everybody can you start waving to make sure

yes from Jocelyn yes for me yes from trustee Marquez okay I think we're good thank you so much a very effective program our teachers really love it and these are teachers teaching the program and we are working with springboard foreign level this has been one of those programs that has yielded a lot of results for our students with full understanding that and this is something that our teachers really love and that alsoever it's going to be done using your devices foreign um the actual amount that I'm paying the district is going to be paying for 315 [Music] if you can assure me that yeah I'm trying to keep the the meeting efficient in terms of time that we need every week just so that everybody knows where I do get feedback from parents and we

are aware already uh and we are working with parents directly to teach them how to set up their devices so we are moving forward on that and we are in a much better place uh then we're a few weeks ago that that certainly happened at the very beginning but now we are four weeks business learning and we have 85 percent of our students connected uh the other five it has received pockets and the teachers are working with them and as you know there are families who are in tremendous stress and we have not been able to connect our classified staff and help tremendously uh going through all the different numbers calling on a daily basis so I thank you for the opportunity of me responding to your question because that is a very with this

reassurance you are able to feel comfortable enough supporting this item thank you through their devices in the curriculum area of foreign okay so um I guess I just want to I will be supporting this but I just want to put it out there that I'm a little disappointed that um uh the executive officer and founders of this I am reading that they are from Philadelphia Pennsylvania online I would have liked the children's money to come closer to something over here that's not the right of services foreign thank you any other questions or comments commentary there are public comments that doctor I mean I don't know it's not Dr Gill correct so Mr Gill um you say that there are public comments well there isn't it no no okay any other comments from um trustees okay

so I I actually just wanted a quick follow-up question Dr Bauer you mentioned that we have because obviously to the community to all of us the accessibility thing is um is the question a thing that we want to make sure we address um and I know you mentioned that we're currently about 85 are connected but do you have any idea or rough estimate of where we started and you know this everything about what we're doing is that old saying that we're building the plane as we we're flying we're building the plane as we fly it so on day one we had to take off in this airplane and start flying and give meals and devices and everything but we still had to build that plane as we were up in the air flying it so

in order to get to those 85 percent um you know where we started and how much we've grown just in terms of getting um students connected we had about half of our students with a device by March 16 which was the first day of shelter in place and nobody knew that if you call this was a decision that the County Office of Education and all of the 31 districts in the county took before Public Health called the shelter in place that Monday the 16th so our teachers in our sites were ahead of the game when they left for um on March 13th that you know that Friday and so I'm very proud of that I think we we had an amazing uh partnership that was able to be executed right away in places like Ocala

Shepherd painter Ryan at Atlanta one a lot of a lot of our schools were already ready to go that Monday the 16th so we have not had a gap of learning for the majority of our students in addition to the schools that were not um necessarily ready with their devices all the teachers had packets read for parents to be picked up that Monday the 16th and for the parents who were not able to pick up their pack markets on the 16th we all we mail those packets directly to their homes so um we have had a couple of glitches here and there and I you know just exactly what you said we were building the airplane as we fly it but I am very proud of the team effort and we are a model for

other districts to follow so very happy about that thank you so so in a span of less than a month we've had about a 35 percent increase in connectivity of students yes and within the two weeks uh trustee gerano if you recall what happened was that we had already secured a partnership with T-Mobile way back when the labor you know approved that partnership we had no clue about covid-19 because you approved that in the fall so uh Alum Rock was in a very good position to be able not only to distribute devices to them overwhelming majority of our students but also connectivity okay thank you very much any other questions or comments from trustees trustee Chavez oh after can you unmute there you go okay um and I want to thank the two translators that

they've been working so hard um a lot of times there's so many people to thank but Carlos and Carmelita have been working overtime a lot because we have a lot of Spanish students and I want to thank you for that um that's it okay thank you trustee can we unmute after thank you you're good I'll have very similar questions to uh trustee um and uh thank you for answering those uh during our one-on-ones power um because my uh and we've already been saying I'm um worried and doing my best to ensure that our children get connected 100 right for now and for the summer um another thing as a leader in this community um we know that as you mentioned the first directive given by Public Health Department was March 16th then you know it's

been raising we don't know how long we have up until May 3rd right now uh but that can very well change as we all know um and you know as schools as we are aware we're extending um here in Santa Clara County till the end of the school year to continue in this way um so I had mentioned um to Bauer about you know our plan our long-term plan to have in place already um thinking about our summer programs you know we as a board we've already been passing other um grants so I appreciate you bower for um you know bringing this and and then also ensuring that all children regardless if they are at the schools or not are going to continue be able to continue to participate because as we all know we're

all going to need our children to be involved with something um to keep their learning going in the summer so um I will be supporting this as well all right any other comments from trustees trustee Chavez uh move the motion okay but before I take a motion let me just see trustee which probably should have done it at first but trustee Quintero did you have a comment on nope a different question okay so we did have um a public comment um I believe from Olivia Ortiz I see that there um and I I don't know are you seeing that on your end after a comment yes and do you see her here in the room yes okay so let me get the timer set up um give me one second okay can the timer be

seen yes and it is Miss Ortiz ready to go are you unmuted yes Miss Ortiz are you can you if you uh can you say something that don't hear her is your microphone unmute are you unmuted on your end message now I am you hear me okay okay yes you can begin hi I just want to comment on the um on the springboard I wanna I mentioned that my son has been going uh this two summers with the springboard uh program it'll help him a lot with his reading um also give us a lot of choices in books you can do books online so I really love the program and I'm pretty sure doesn't help a lot of kids so hopefully you guys can um has a also springboard gives the kid a tablet by

the end of the uh by the end of the program so each kid will have a tablet if they if they um that's what they used to do before in the past I don't know but now but it will be also really helped for the kids so they don't have tablets right now be online thank you I just want to mention that thank you okay back over um I didn't see anything else Avatar did you see any other comments from the public just there is none okay so uh trustee Chavez I sounded like you wanted to put a motion on the floor for this item can you hear me trusty Chavez can anybody hear me I already put the motion in oh yeah uh do you have that Mighty bad and uh trustee era is

either telling us peace out or she's seconding I think she's seconding so we have a motion and a second on the floor um is the mo wait can you state the motion trustee Chavez just to be make sure everyone has it what are you moving pardon can you state the motion oh sure are you moving to approve is the question because that's what I moved to a proof okay and that's the second is for approval correct correct okay so there's a motion on a second on the floor to approve item 4.01 um I will call each trustee for your vote trustee Marquez yes can you stay uh can we take everybody off mute NASCAR because we probably need the audio okay trustee okay trusty Chavez yeah trusty Quintero hi and I for myself so the

motion passes unanimously thank you everyone okay we can move forward to item 5.10 approved board member term limits of three consecutive four year terms um is there a motion I guess to um we should have done this on the last a motion to um get the conversation going I have a motion that I would like to amend uh I would like to amend the motion to include that no expenditures disbursements resources staff time will be incurred by the Alum Rock District in putting this item forward and or on the ballot so I'm not sure I'm going to go ahead and ask our legal counsel I my understanding is that we need first of all there's not an emotion on the floor to amend yet um but I believe that as agenda as we would need

to um approve that but can you confirm or correct that um Mr Ruiz are you frozen yeah motion first and then but can you can you start over Mr Ruiz we were having a little bit of a glitch here with you we couldn't couldn't there you go it looks like you're up now there would need to be a motion first before something could be amended emotion you motion what on on the item 501 I motioned in trustee uh Marcus I think just second wait what but can you state your motion please okay the motion the thing is is since I'm not voting to approve it as is that's why I'm just motioned together you might you might want to you might want to wait to see it I don't know yes oh I think the

trustee I don't know what I had her hand up before I did before I called you uh uh president when I raise my hand on the thing are you able to see that um I haven't seen it thus far okay so it probably is not working I'll just keep doing my hand yeah either that or just leave your mic open and and you know just speak up when when you need to and I'll hear you okay so I motion to approve board member term limits of three consecutive four-year terms okay so there's a motion on the floor specifically first of all to approve board member term limits of three consecutive for your terms is there a second to that motion uh all second for the purposes of discussion okay so there's a motion and a

second on the floor for the item as agendized um trustee Chavez I know you wanted to make an amendment would you um I don't know can can we have I trustee Chavez I think that if you allow us to have a dialogue then you may want to you may not have to put forward the amendment that way we can just move forward if you understand what I mean sure go ahead so I I will defer to the maker of the motion and the person who put forward the item first and then I'll I'll make my comments after that as my colleagues know we have listened to the community members as well as have discussed this item at length um and then three of us have made it clear that we were in agreement between three

four-year term limit um and then in the spirit obviously of keeping our meeting concise and you know short as possible um while also addressing all the important items um at the length that you know they uh uh should be discussed at um I I also am aware about a possible I mean rounded off eighty thousand dollar possible increment of uh you know addition to our budget if um if passed um just thinking of the item um at length you know uh I'm the person who brought it forward to this month um and just thinking of what our district specifically needs our needs are here um with you know just the different leadership you know uh that we've gone through that we um have and just in general um you know seeking uh General turnover of

leadership and having those of us that you know serve who knows right I mean it's my first year but a 12-year term um that that should be sufficient um I thought it would be important to to bring It Forward um and then let the community the public you know decide um and then also keeping in mind that yes our our public our community are the ones that that vote Us in or or out you know pretty much um also just calling on our community I'm not sure who's listening right now you know but um getting the message out that we need to be involved um in our local school politics you know um all of all of our politics all of those that make decisions on behalf of our communities um to be involved and

to know that when we vote you know we know who we're voting for um but yes so anyways um I'll just keep it at that for now all right thank you um trustee Quintero and also trusty Marquez if if after if she speaks up that she has a comment just raise your hand or something so I can see when she has something to say Thank you so try speaking turtle go ahead so um I have a position with regard to term limits um that uh you know the fact of the matter is that me and trustee markets are the only ones who've been here over one term uh so the board is completely brand new and uh my position is that we don't necessarily need them but folks are asking for it and the community

feels it's necessary then um we can move forward with it and uh before I before while I was at forums and I was asked what my position was I clearly told folks I was not supporting two terms and I've stated that my position is that I will support three terms and I still stand firm with that however um we're facing very serious uh circumstances that are are beyond our control it's not like somebody concocted Coronavirus just to keep us from putting term limits on on the ballot and so I'm not saying that to any particular board member or anybody out there I'm just saying that that's the case and and the the circumstances being what they are um we have to go ahead and deal with them as we get them uh about two days

ago or yesterday um we received a letter from the assembly budget committee uh that our finance uh folks got received and then they passed another Dr Bauer letting us know that this and it specifically spoke to the covid-19 situation and talking about all the commitments that they've made and so it's looking like our budget wasn't going to be all that great to start with and now we're going to be facing even more dire circumstances especially when we're talking about um when we're talking about general fund money which is the pot of money where this 100K is going to come from um and so we we do have uh to incur the cost of translation of putting things on the boat on the ballot and at the end of the day it's going to be it's

going to be it's going to be roughly 100K that we're going to have to contend with as we're facing very very difficult times in the near future and so for that reason I still stand firm and I've given I've stayed in my position in public I would support the three tournaments but at this time due to the fact that I didn't it's going to incur this significant cost I would ask us to go ahead and consider moving this down the road once we have a better understanding of the budget then um we can go ahead and possibly revisit um this uh this proposal and so that's my position um given the the new information and so I would all I would ask if um Dr Bauer or colvera can elaborate on the contents of the

letter from the assembly budget Committee just to kind of elucidate the board as to our the the financial uh forecast for for us as a school district now well Grant and we also are not basicate so we have to go by what they are what they are telling us so more president I would ask uh if Dr Bauer or Colbert can respond to my question about that particular letter that we received just a few days ago okay thank you and then just before you answer um I do see that trustee Marquez has a comment so trust I mean um superintendent Bauer if you can respond to that and then after that trust me Matt gives you um you'll have you can speak after that I have asked Mr Chang to respond to that thank you

yes good evening this is covert Chang um I do want to give some background in terms of that letter from the chair of the budget committee and what it speaks towards is that the the state itself is going to be implementing what they call a workload budget and what that means is that they're going to carry all the programs that they have currently but everything that they propose in the January budget proposal in terms of new programs new initiative new funding all that's going to be shelved and so there would be no consideration for any additional funding on top of that there has been some conversation regarding um and even additional decrease in Cola you may recall that um in the June budget the cola was at three percent and then it was dropped to

nine in January there's a discussion that that 2.29 could be reduced further when the mayor revised comes out so uh we're not hearing a lot of good news with respect to the budget itself but um those are some of the new highlight information that's available to us right now thank you Mr Chang trustee Marquez um hopefully you can hear me and I think we'll be able to hear you so my understanding is you have a comment or question Marquez can you hear me something's not right it sounds a little choppy after are we able to do we have connection with trustee Marquez yeah we we do have connection but it might be her cell phone reception okay let's uh give it a second trustee Chavez did you want to say something now I also have

a comment that may inform your motion but if you want to make your comment before mine you can certainly do that at this time sure um am I muted you're we can hear you okay so I will support three camera limits but like I said before that I can't support the district paying for this at this time especially with everything that's been going on and we're going to have less money I just can't see that right now maybe later on down the line and Mr Ruiz is it my understanding that if something were to be put on the ballot that the district would incur that cost I believe you um gave us that information in November oh uh after can you unmute uh Mr Ruiz you're you're unmuted so that's correct if if the board

approves the motion that's on the table uh and this agenda item what will happen is a resolution embodying this book we'll come back to the board meeting for approval by this board which will be a direction to the Registrar of Voters to place this on the November to 2020 ballot but in which case the district will have to pay the fees to have it placed on the ballot so yes that's correct and there's no there's no other option to that that is the way that it is set up to occur correct so the only other option well no the district always pays so um the other the other Avenue to get something on the ballot is by initiative but the initiative is is presented to the Registrar of Voters and even then the district ultimately

pays the fees so yeah there's really no way around this anyway you slice it we would be on the hook for the eighty to a hundred thousand dollars that that's correct but you know the November election is the general election so there will be a con and you would consolidate this with election as well I don't know what the cost is but it's a reduced cost because it will be is on the ballot so yeah I spoke with the Registrar of Voters and they um informed me that it would start at the 82 with the condensing of the the everything on the ballot it starts at the I believe 82 in addition to attorney fees and and I think language and all those other kind of extras do we have trusty Marquez up yet Avatar

can you hear us we can kind of hear you can you can you try to get going and maybe the connection will improve trustee trustee Marcus dial the number again I will disconnect you okay while while she's doing that I'll uh or trustee Chavez did you have any other further oh maybe she stepped oh no that's it okay um and then I I don't know if everybody heard this but let me just reiterate as we're getting into this if you need to step step away for a moment please feel free use the restroom or whatever you need to do um so my comments I um you know I know that we've talked about this um it's been on the agenda three out of the past six months we've talked about it two times at least

in other comments in other months um so five of the past six months at some level we've discussed this and in those opportunities most of us including myself have kind of given the information that we have along with the community which we will get to community community public statements or public comments um but um I know that there are also this format that we're using today you gives or provides access to maybe people that had not seen or heard that before so I'm gonna try to be brief but I will I'm going to be stating the things that I have said so some of it will be repeated and some of it is is a little bit new but the I want to make sure that the public knows um at least for myself when

I make my vote what my rationale is and be very transparent about my thinking on on what my position is so so as I stated the very first time this came up I continue to believe that this is a a solution without a problem really that that's um I know people feel strongly about that my position is that as a solution that we don't really have a problem for the reason why I say that's not my opinion but it's because number one in the past 20 years only two out of the last 17 trustees so out of um the 17 trustees that have served in 20 years only two of them have served more than two terms all the other trustees have served within four terms whether they left on their own or were voted

out um I think it's unfortunate there's been some information that's gotten out into the community that term limits have led to Decades of bad or lack of term limits have led to Decades of bad governance however the facts are at least in the past 20 years that there has not even been one decade of governance after the third term of anybody who has had a third term so there's been two trustees that have served three terms although they haven't been consecutive and both of them one of them is currently sitting one was sitting in the previous um on the previous board so there hasn't been one decade even to to see whether or not the lack of tournament limits led to bad governance Maybe people maybe have the opinion that they didn't like the governance

while they were sitting but there's no way of currently knowing whether the length of their term was resulted in decades of bad governance the two people that I mentioned who have served more than two terms they were not consecutive but they did get re-elected after a break in their term they both got elected in first place by the voting public and that voting Public public knew that they had already served two terms but they still voted them in and voted them in first place not only did they vote them in the first place but one of those candidates actually got 13 000 plus votes so that was in my research that was the highest number of votes that anyone had received by the voters for a candidate that knew that they had already served two

terms in terms of research by the academic academ academics who are experts in the area the research that I found demonstrates that districts with high academic performance have trustees who have served a minimum of 12 Years so 12 years is like the starting point where they begin to see stability and um I see you after they begin to see stability of the board and and real Effectiveness in terms of moving yes ma'am policy I I want to make a comment I want to hear everyone I just want to wait for the vote okay so let me just continue um so a minimum of 12 years is what the research demonstrates because more experienced trustees are more effective in terms of having more collaborate building more collaborative relationships and being able to bring resources to the

district um you know I certainly understand and appreciate trust attention to the desires of one segment of our community who who feels very passionately about this and there are numerous people in that segment of the community but my my thought is that as trustees we also need to remember that there are many many thousands of Voters out there who for whatever reason aren't able to or don't participate in these processes but they participate through their vote and those votes at least in the past have clearly demonstrated that that they have a different opinion of what's on the table tonight and I for me at least I I have to consider their perspectives as well the cost we've brought up um a little bit that's very concerning before we were in this current situation I was

of great concern to me just the you know 80 to 100 000 range of of costs incurred to the district um and then I brought up before that I know we still um trustee Chavez has has put in a lot of work trying to push us to get this uh handbook going and also we've been trying to get our strategic plan going both of those are recommendations from the state audit we voted down the opportunity to do that a few months ago for twenty seven hundred dollars and those are we have to get those things done as per our state audit those are things that we have to do and that was twenty seven hundred dollars to get that going and we didn't approve that and now we're going to look at approving a hundred

or whatever for something that we are under no obligation to do and it occurs for free every two years the voting public has the opportunity to choose their representative and vote someone out if they think that there are um serving in a way that doesn't serve the community the state gets the money my understanding I'm obviously not a financial professional but our state money comes primarily from capital gains taxes is what I've read Mr Chang could correct me if I'm way off on this and what I've read is that two months of bad um of a bad economy in the state of California would equate to you know that that level our reserves would be a problem and we would you know start be having issues we're already almost a month into this so in

about a month the all the the impact of these businesses being closed and and no tax money coming in is going to be significant in addition we were losing students already we have had a trend of people leaving the district and I wonder about the number of families who will be now under these current stressors forced to leave our area leading to further low enrollment and and challenges that I think we can foresee in the future future um I have a couple more I know this is long but I really want to be transparent about this a few last year we um we cut our our safety our sros from the district we cut that budget in half of a hundred thousand and in a report that we're going to receive tonight we'll see that

the students in their survey said that they feel unsafe in their schools in middle schools and last year we spent 000 less to cut the sro's budget in half and now that's what came if my understanding is correct then we'll hear that after but it's hard for me to know that that decision that we made is now making our middle school students feel unsafe and now we're looking at spending an additional up to a hundred thousand dollars for something that we don't need to um so I do agree I think that we should let the voters decide but my opinion is that they decide for free every two years and we don't have to take money away from our kids to to do that all of our neighboring districts believe that their Community should have

the right to to vote in the who they want to represent them um and and all our you know signs of unified or evergreen or Berryessa they allow their Community to choose who represents them and not be forced into representation and I think our community deserves that as well so thank you for allowing me to repeat that I apologize to people who've heard that over and over but I want the people who are new to understand my position that I um particularly now with the current challenges financially that we may foresee will not be supporting this item tonight um trustee Marquez um I thought I heard that you said that you don't want to make comment you just wanted to hear but if you want to make comment you can and then trustee Chavez um

I think maybe you might be after that if you had something do we have trustee Marquez with the comment SD Marcus I I yeah no I'm trying yeah yeah your phone is not working properly we hear you we hear you very chopped um trusty Marquez is it possible to either I don't know how many people have a landline still but if you have a landline to use that or maybe move to a different area of wherever you are to get a better get better reception [Music] um oh I'm trying to think or write it down and send it text you could you could text yeah text it so is the issue that she doesn't have access to because some of our community is able to we hear them very clearly when they make public comment

so but that's not an option for trustee Marquez Avatar to participate in the same way that our community does um in public comment yeah she can also email the public comment or have a send a text message to the number given but she but she can't like call in the way we've heard our public comment people calling in so so the challenge is her phone the actual handpiece uh earlier she commented that her hand piece is too hot so maybe I don't know what the technical glitch is that but that is on the device itself so so whether she call our conference Bridge or she calls this line it will be still the same yes thank you okay so trustee Marquez if you can hear me hopefully um we would love to have your participation

and and hear your comments on this if you can either get another phone someone else's phone a landline um or you can text something as best you can where this is the plane that we're trying to build as we fly it but for now maybe Avatar can work with you on that and trustee Chavez um or anyone else that had further comments or questions can chime in and then we'll go to public comment and we can even go to public comment and trustee Marquez can comment after that if she needs to so anyone else have something trustee Chavez maybe one more thing um Even If This Were to go to the ballot if later on we decide to do this not now because we don't have the funds I mean we have funds but I

don't believe that we should allocate those resources for this at this time um even though if it does make its way to the ballot they're still grandfathered in that means some of the public don't know that if you vote on this um they still can run again because the terms that they've already been that been expensed that they start from fresh so it's still if you wanted to get a certain board member out they still have would have three more terms technically am I correct with saying that Mr Rogelio and she hung up I think he's Frozen if the measure is approved it oops that you know you're good now okay that's correct if the measure is approved by the board then it would only apply prospectively meaning anyone from this point forward from that

point forward if it went through and not to people currently sitting that's correct so it would still be that they could run another 12 years correct that's correct yes so it could be a hundred thousand dollars wasted for for nothing thank you do we have trusty any news from trustee Marquez not then after go ahead yeah so the trustee Mark is phone has some challenge so I suggested her to send a text message to the number given so I just sent her the number uh the phone number to text and I'm waiting for if there is any comment from her okay so then at this time we do know how many people we have for at least Prime initially for public comment on this correct through email or text and I think we'll probably have

some people that will raise their hands as well but through email or text we know how many we have is that correct I'm checking with Mr Sanchez okay we do have yes we do have how many comment do we have in email or text just trying to be mindful of time so there are about six comments okay um and then I assume we'll probably have a few hands raised through Zoom some of those may be I see one person here miss de Leon I don't know if she's included in those six but um so we'll go ahead and have public comment we will have um given that they're six and maybe I'll assume a few more with raised hands um so seven I guess she's not one of those so seven comments um a few

more probably with some translation I think we will go ahead and just allow for two minutes as well for public comment on these items so we'll go ahead and do public comment and then hopefully we can establish something with trustee Marquez and then after that maybe um finish it up and take a vote um so let me just get to my my timer and meanwhile after can you line up our get our public so so we're going to be reading those six of them correct so six public comments yes Mr Sanchez he's reading those public comments now are they all English or English and Spanish or what is the status of well uh some are all English and some are Spanish okay so what I'm going to do is I'm going to still set the

timer for two minutes so um whoever Mr Sanchez or Mr Moran I believe whoever's reading you can just read at a you know a normal pace of what someone would provide public comment and when the two minutes is up or four minutes for a translated one then that will be it for the comment is that clear for these written ones yes okay so let me share the timer can you all see the timer yes all right are we ready to begin reading those comments yes is this in English or a Spanish uh this is I'm gonna read it in Spanish then in English or are we going to translate all of them basically the ones in English I will not translate those are being translated by that's right okay okay so I'll start the timer

and then at two minutes and when it starts you can begin okay uh when I started this board my name is severe IGN gracias so um now I'm going to read it in English Okay so let me let me reset okay ready good afternoon Dr Bauer members on the board my name is Araceli Sierra mother of two students in the district today I come to support term limits not only as a mother but also as a member of the community to you and to you supporting the term limits are for you to I'm sorry and this is written this way so I'm trying to read it here um supporting term limits are now giving voters the opportunity to decide on the ballot um in 2020 November 2020 this policy that gives you the opportunity to

learn grow and focus on Student Success bringing good governance and parents like me the ability to believe again in the district please support term limits thank you okay thank you we have do we have another one next yes all right go ahead this is in English um from Ray Raymond Mueller superintendent president and trustees term limits are good for our community as they provide better opportunity to create pipeline of interested individuals take part in the system that governs our district in the Years leading up to 2018 election we all were made aware of the pro cronyism nepotism and even some blatantly inappropriate behaviors we're doing to our district when the fact raised entrenched trustees dug in their heels and even used terms like fake news to discredit those of us who spoke out our district

has storied history of some pretty obnoxious trusty behaviors one must wonder why they felt entitled to act out in ways that we don't even let our students bullying fighting name calling lying vehicular assault are just the tips of the iceberg that sunk Administration for decades even when the public vote vote them out they just come back two years later and return to that chair enough of the past let's discuss the future what if a Kinder parents or a Kinder parent um started out on PTA School site Council and one of many committees in the district and after a couple of years became more involved and with some support from a board that wants new people they gotta to attend a retreat and realize this is something for them they have the working knowledge of the

schools and they have the investment of child or children in the classroom they show that daughter they show that daughter or son that anyone can truly grow up to be an elected official um after two or three terms they are replaced by the Next Generation the working knowledge stays current to the needs at that time okay so that is there is it almost done or there's about three more sentences um okay if you read them fast the opportunities for inappropriate behavior are reduced and finally our district can stop being the brunt of news coverages and even jokes amongst the community our property values go up and our neighborhoods thrive um I'll just wrap up with the last sentence I encourage and ask the board to support term limits voting yes on the term limits will

allow voters to decide if they want um this policy in November 2020 election it's not about any one of you it's about every one of us in Alabama okay thank you and the reason why I just let down go a little more because I know up front there was um a delay but it was a little longer but that's okay so do we have the next one so um can you reset that is there an another English one lined up and out and when the timer starts um Mr Sanchez if that's when you could just um State the name and just start reading um you don't think you need to say if it's English or Spanish just to conserve time so are we ready for yes hopefully that makes sense okay here we go Claudia

okay go ahead uh good afternoon my name is Claudia um a parent of a special needs student at in Alum Rock Unified School District I am here today to support term limits I have seen way too much corruption lack of student representation and too many egocentric people have done in the trustee chairs our community is tired of poor management past boards have shown and wish for this to stop the one the only way we could guarantee is this through term limits thank you is there another one yes are you ready yes okay my name is Sonia Solano hello I want to support the policy of term limits of of limits because it is an opportunity to have more access to the community and to participate in the Democracy that this country in this country and

the state of California is that it for that one that's it for that one okay let me know when you're ready for the next one okay hold on one second okay um one last one I think you ready for that one yes okay go ahead uh Natalie doubt about um I nuttedly doubt about a parent of three-year arusd students Community member and activist would like to have on record for public comment that I am in support of having three term limits for the AR USD board with the history that we've had I do not believe that anybody should Dominate and sit in our board as history has shown for 16 years over 20 years over a decade Etc our district is doing big things and heading in the right direction and would like to keep

it that way please meet the community in the middle and support three term limits 12 years on the board is ample amount of time to serve thank you okay thank you did I hear you say that was the last one I am looking one more time for today that is yeah that is the last one okay I did see um one individual through the zoom Miss de Leon is it accurate that you um want I'm assuming you want to provide public comment in here um I'm talking we unmute flor de Leon yes she does have a comment so um is Avatar there let me see if I could do it um Miss Hernandez also said that she do we have an email or a text from Miss hernette Mimi Hernandez who said that she had

a comment that was not read is anything come in I don't know when she sent it in um but and also miss dilsa Gonzalez said that she had sent a text earlier it seems like we might be having some challenges with that text to email system but we do have three at this point Miss de Leon uh Gonzalez and Miss Hernandez after or anybody so first of all can we um unmute I believe she's in the room Miss flor de Leon so that she can provide her public comment while we're working on several everyone else can see these chats correct I'm I'm reading them out but you can all see that right Avatar yes okay so I will I'll stop reading those you see the people who have also mentioned that they email or texted

comments um and I'm not sure if they're in the room I know Miss de Leones um I don't know if anyone else is that would be able to do it through through voice so let's open up Miss Dylan are you there Flor yes can you hear me yes give us one second please so miss de Leon will um we'll set her up to do her public comment and in the meanwhile um the red the other people who said Gonzalez um if you can please email re-email or re-text your comment um so that it can be read and while miss delonis miss de Leon is speaking after I will be working on that okay um so miss Dylan Miss de Leon are you um ready to start your comment okay so you can see the timer

um can anyone else see the timer no okay let me re-share it I'm sorry see it now no yes yes I can see it Miss de Leon most importantly can you see it was that a yes yes okay so we'll get started as soon as it starts you can begin okay so um I want to start with first saying that it's very important that uh trustee markets which has its press in the past that supports and limited is not in either here in the comments and that she is not being part of making uh having problems with her cell phone so I don't see that you know like uh like transparent to be able for her to hear what we're saying right now but I want to say too you know that um communities voice

is very important and uh as you understand the parents are the ones that are advocating for the kids and actually our kids and are the stakeholders of this district and that's how we make money with the district and I understand that we're going through hard times but with what we we have seen in the past even though you say that that the the people that have been for over three terms are not been here for over 20 years but in 20 years they're going back and forth and you know you guys know how everything went to all the outages keep mentioning is because of mismanagement of our funds and the way that the district was running was not the best way we spending millions of dollars with lawsuits and all that and 80 100 000

is not a lot and sometimes it's um there's some necessaries that we have and we understand where respect when there's necessary things and for parents this is an investment and we have seen it many times and he's really uh not appreciated not to be her and and we're not just a small group of parents that want to make travel because we are not here for now we are here to work together and you have seen us staying in these meetings to give our input uh very late and other people that are not here is because they are not involved parents shouldn't be the ones that bought you or being taken those places but unfortunately how everything works is that the borders are the ones that have the right but just like San Francisco the residents

and the parents are the ones that put the trustees on board and hopefully one day we have that policy in our thank you very much okay um after did we receive anything yet from those other individuals or have we come up with anything in the past two minutes yes we received another public comment via email okay so is it English or Spanish um I have two um in English and Spanish okay so we can we'll are you prepared to start with the English one right now yes okay so when the clock you can see the clock right yes okay when it starts you can begin with the English one okay this is as a member of the Alum Rock Community I implore you to show your commitment to good governance by approving the three-term limit

for board trustees respectively Janet O'Dell okay thank you and then you say we have a Spanish one oops we have one in Spanish yes okay so I I'll just start the two minutes for the for the Spanish part and then I'll restart it for the English okay you ready to go yes okay go ahead noches okay and you can go ahead and read the translation um my name is Laura I am a parent here in the district um I come to ask um for you to support term limits um this is something that we've been asking for the last six months term limits are going to help us um finish or end 20 years of corruption and it's gonna provide us the opportunity to have 20 years um that we will ensure um school Success

for our children let's let the voters decide and and secure um that democracy that there's democracy in our district thank you good night okay thank you and was there one more there is I think Miss dilsa Gonzalez had said that she had said something there's a couple more that have come through this one um are we ready are you ready I'm ready if you're ready I'm ready okay uh you can go ahead and begin Mimi Hernandez uh rise up on Lamarck was born during the past election to eliminate corruption and stagnation our board uh reminder many of you supported term limits as candidates some of you are now condescending and unsympathetic when we as a community demand is important issues to be addressed rise up Alum Rock remains Vigilant and we hold candidates leaders and

current board members accountable if they fall to if they fail to address in past term limits the term limit policy um policy three terms is a fair policy which allows board members to learn grow and focus on Student Success um two now it is the time to approve this policy we cannot allow another 20 years of possible corruption on the board because we do not have term limit policy we want the next 20 years to be about Student Success listen to parents we are the student Representatives voting yes on term limits will allow voters to decide if they want this policy in the November 2020 elections after the board passes this policy voters get to vote on it voting yes for term limits is the right step to bring transparency good governance and Trust to

the arusd board go yes on term limits today Mimi Hernandez okay and there's another one correct yes this is from Delisa Gonzalez okay are you ready with that one yes I am all right you can begin good afternoon board my name is dilsa Gonzalez I appreciate that we address this issue with the importance it it's needed um I will I would like to know how we are involving parents and teachers in this decision that are related to our students and how we are addressing special needs special ed students this one just came through so and what I don't think this one is specifically on term limits I'm sorry okay should I read it anyways um so it's separate from what you just read there's two comments here here's the second one okay yeah you can

read it now okay here's the second one for this from the same individual if we could start over agenda item 5.01 uh good evening board members my name is Gonzalez I am a parent of three students that attend arusd I am here to ask the members of the board to pass term limits term limits will finish this with years of bad governance and will help new and future board members to focus on our children's education let's focus and continue with good governance by letting the voters decide on what the district needs this is necessary is a necessary investment for our children make the right decision tonight you have the opportunity to listen to parents community and voters that you said you will represent thank you okay and was that it that was it the other

comment was um was on something else okay so I believe we can you can you all see me again or the timer yes my my regular screen okay thank you did I hear someone say something yeah it's me trusty Marquez superintendent Bauer oh yes Dr Bauer I have an update from thrusty Marquez and she wants to be excused until closed session it's very hard so she wants to let it cool off so that she can join close session and she wanted me to share that with everybody okay and she didn't have anything specific to this item no I asked her asked her she said she said that in not a good place okay thank you trustee Quintero so I think you better you're muted oh Avatar sorry okay now I think we still can't hear

you can you hear me now now we could hear you oh sorry about that I was muted um so I think it's a very important item and the community is expressed uh their concerns about the fact that uh trustee Marcus is not here so I don't see anything that holds us from deferring this item till the end of the meeting until right before we go to closed session so that she can join us and make her position public and she can actually take a vote on this particular item so I would ask us that we we go ahead and hold off on the side of but before I give up the floor I would uh say that I'm at some point in time in the future once we uh get a better understanding of our

finances I'll gladly go ahead and move forward and support this item at this point I can't um but I will also uh encourage us to start looking at other places I think that the for example the County Board of Education went through a series of superintendents for a period of time and and uh and there was this function there for a while so uh maybe it's right for force uh for for term limits at that place and and so let's all start actively looking at other bodies that uh or term limits May wind up bringing the the results that we're looking for in terms of fixing all the problems that we've observed um so um just putting that out there to the community that we can all actively start looking at our the next folks

where we're going to be looking at and I'll join you in that as we move forward maybe they have the finances to move forward sooner than us um all right uh but I would put that before this body if we can go ahead and defer action on this item till right before we go to closed session so that trustee Marquez can be uh can participate um just a thought and we can consider that can I ask for a clarification so you mentioned um I think the a couple other districts and something about their term limits what was it again that you were saying that they had problem issues or something oh no I said that um I'm appreciative of the fact that folks have brought this up here at Alum Rock and I look forward

uh to see it being a springboard for me to join them in going um to places like the County Board of Education that had some some significant dysfunction for quite a bit of time um they uh they went through a series of superintendents over a very short period of time and maybe it's time that uh we go ahead and start looking at term limits at that level as well as others that may be right for that um I see in the comments uh that a bunch of people are saying that they're raising their hand and they're saying you shouldn't let us speak I am assuming I'm assuming that they're saying you should let us speak so but I don't know I would encourage you to take a look at the yeah I'm I'm seeing those

and I think that Avatar also has seen it I just did want to respond though to your um part of your comment um I appreciate that perspective but one one part if I'm understanding what you're saying correctly one part that that um you know it challenges me to think a little bit more about is that I understand like a lot a lot of what I hear and feel myself personally is this there's an emotional aspect of what many of us have gone through over the past several years certainly yourself trustee quite more than many of us but also some of us that were in the community and and some that are sitting here now for me at least there's definitely an emotional aspect of that experience um and it sounds like there was there's also

you know in addition to the emotional aspect there's you know there's these pieces of you I think you use the word corruption or just whatever words that other things that others districts may have experienced that that may influence someone to want to consider term limits the thing that I'm that makes me wary though is is I'm very cautious about um looking at kind of recent or short-term incidents or not that short term but just responding and being very reactive to things that have occurred um and and making decisions and actions based in large part on that whether it's you know a series of superintendents as you mentioned or whether it's a drawn out thing that we went through here in Alum Rock as a leader in the district I think that it's incumbent upon myself

and upon us to make decisions based on you know certainly to consider our emotions and and and those things that are part of us as humans but also to make decisions based on the factual information so so when we talk about um you know considering other districts that have had kind of recent whatever the issues where I don't know exactly what you're referring to but you know if we get to that point down the road or whenever it is that would be kind of where I I would kind of be coming from is a place where um you know where I would want to be not reactive to things but really very proactive and strategic and long-term in my thinking trustee I see your hand up I'm in agreement with them on on this mentions

with regards to moving it at the end um and then I just a suggestion that we hear what the public has to say now um because who knows you know what time that'll be um so I would just suggest that maybe we hear what the public those people that have raised their hands have to say now um and then you go on it at the end and then just really quick in regards to you know your comments in regards to you know um the reasons we're here um as we all know you know most of us were voted into our seats to represent our constituents and it's pretty clear that at least 17 of our constituents right um are in agreement with this um so I just want to reiterate that um you know and

we all have our reasons that you know in whatever way we're gonna vote and we respect that I respect that and I know that you know as my colleagues we respect one another so I'm looking forward to that uh vote taking place um and I you know I'm in agreement with quintero's suggestion of doing it at the end of the meeting yeah I think we we will do that um but we can still um and we will have the public comment because I know there's uh you know this is challenging the way we have it all set up so we will have further public comment in a moment um but we do as trustees trustee Chavez did you did I see your hand or no no okay yeah the other I I appreciate those comments

trustee and for sure you know we we are all of different minds and different perspectives and nice certainly respect everyone um for whatever they their opinion may be and their and their vote um I just primarily at this point given what we you know what was shared with us from trustee Quintero and the letter that was read to us about the upcoming budget um you're right we do have part of our responsibility to be responsive our to our community um another part of our responsibility is to be the fiscal stewards of our district and to me I just I think that it would be I mean I I would probably use I would use the terms Reckless and irresponsible to to support spending a hundred thousand dollars or eighty thousand or whatever it is at

a time when our future is very unknown financially but we do know that it was not even starting at a good place prior to this stuff so it's just for me personally I would feel that that would be irresponsible to to add that financial burden at this time um just respond to that before we go to public comment hopefully you know just want to mention that as a trustee you know with everything you said in an agreement you know um also during this time you know of course our budget is getting hit as we speak um I have committed myself to look at you know grants and you know maybe even support um our district and applying to getting more money into our general funds um you know who knows you know maybe it's you

know only 5 000 but maybe it's a hundred thousand um so I do commit myself personally to you know support supporting that the district in that direction um but I'm in agreement with you you know can't I mean definitely our fiscals you know our budget's important without that we wouldn't have a district to govern um but with that hopefully we can go over to public comment and that's awesome and we'll get there but I I appreciate this dialogue and I think it's important for us to have just so we know um I'm still open to being informed but um I agree I know that you do work hard just personally I know that you know you you do your homework and and you're looking at Grants and we're you know we're all considering things that

we can do for the district but I heard you say it might be five thousand or a hundred thousand who knows and you're right like we could get who knows what kind of Grants we might be able to get but it is that who knows part for me that is the variable it who knows if it's if we move forward with an item like this and then the who knows part ends up being 5 000 and not a hundred thousand then that's the position that I don't want to end up being in but for sure I know that um just on a personal level as we know each other I know the work that you do to try to bring resources to the district and the community as well you know I know they're working

to make um to have collaboration and leverage the relationships that we have in the community so Avatar do we have set up at this time um the people that want to speak I was trying to in part I was trying to stall to let you set that up because I saw a number of people coming in and I want to make sure that you're able to manage that so do you have that um ready for us avatar for public comment yeah there are four hands raised Olivia Ortiz Brenda zendejos Maria Martinez Victor Vasquez so I will unmute them one by one so first is Olivia or let me let me get the timer up first and make sure they can see it these are Zoom um comments correct yes okay let me get the timer

can you see the timer yes okay are we are you ready are you can when they start talking I'll start the timer Olivia yes I'm actually very disappointed about you guys trusted Hannah are you showing me how much you respect our community and our parents it was public comment and you guys should respect our time if it's probably coming you guys have enough time to talk to each other and we have things to do I have Childs at home so that I need to work with them it is very it's really shame that you guys are just having us waiting and talking and talking and talking when it was our time to speak shame on you guys also I have no respect for you guys because I know you have changed your mind so many

times about this this policy this journey limits last time I I was there at the at the district meeting you have said that you were gonna uh uh support the three terms also uh trustee uh Quintero I said to support three times you you guys will leave us another another way but we have to different way which is gonna it's gonna cost more money to the to the district which is something that we don't want with our communities asking you for for this since six months ago we're working longer than that and you guys you guys been taking forever to listen to their Community First of all we practice up six months ago and you guys didn't want to listen to us shame on you guys and I am really really pissed I usually like

to work with you guys and talk nice to you guys but today I am very disappointed about you guys the way you guys are acting so the community out there let's stay engaged Let's Take Action see you let's see the stresses are working with us and they're not we can do a lot we can do a lot on election days know that we have to take action these people because you have to respect us we're being gay we are engaged in the meetings every month and we we want to work together but it seems like you guys don't want to work together together with us the community out there please let's do something about it let's be out there on Election Day thank you thank you okay um do we have the next one lined

up after or let me know when we have it yeah give me one second let me so next will be Brenda and I actually I think I'm um I can provide clarification on a public comment a brief clarification the brief clarification I would make to that past comment was that I had stated that I would support um three term limits as a as a reasonable thing to discuss I also clearly stated you could check the video that I that did not mean I supported it um as a an action item so you have the next one ready yes Brenda okay um yeah whenever you start talking I'll reset it okay I just want to say that I am here to support okay oh sorry I thought I hey you can go ahead okay I'm here

to support three term limits I'm here to stand with my community in solidarity and I also want to say that I am very disappointed but I understand why you guys are changing your minds I mean I think we're always going to have an excuse if it's not money it's you know we have great trustees that you know they're gonna do a great job so I see that you guys are not going to support it so I'm not going to waste a lot of the time here today um but I do want to say since a lot of you guys are concerned about the money we can save a lot of money right now the kids are not in school we can turn off all the lights completely because there's no staff currently right there's so

many ways we can save thousands of money or we can make this happen we just gotta look and really really make this a priority but I know it's not for you guys um and I know that I did say three term limits but I see why he's changing his mind and um since that's the case I would assume he's not gonna run again since he would be done with three term limits um and he will open that space for another parent hopefully we can get a lot more parents that have kids and I also want to say to you but here I know that we're not just a segment of parents we're parents that actually have kids in this district and most voters don't and sadly that is the case and like floor said this

will change soon and we will work together to let them vote if we can let undocumented or residents vote it will change the Dynamics in this board because we really need to voice our parents voice and for you guys it's maybe not a respectable voice but for me I stand with them because they are the mothers and the parents of our kids there are Advocates there are union members for our kids which have nobody but us thank you okay after do we have the next one lined up he has give me one second okay okay next one is Maria Martinez okay do we know if it's English or Spanish um Maria are you able to talk right now yes in English or Spanish you can hear me yes okay in English or Spanish that's English

is okay okay so whenever you start talking I will start the timer okay hi thank you trustee um superintendents and um in the community I say my my college the parents I want so so Madden this time uh I know that you making the a lot of comments right now and you're making your searching about the how many times that had a trustee they had for more than 20 years there but even in Cuba only Castro that'd be there one person and and that's why we don't want to happen here in Alum Rock that not necessarily they have a lot of people that be stay for a long time that's that's only with one person a good leader they start ready to to leave this position and we try to get another people to represent

our kids even like floor Dimension community and a school first they they stare for the November we the parents we try to move too hard to get this forget the money you're already closer uh Arbuckle and you have the money I know that that's not your fault because the other people before the other trustees they are all all this mess but for this time we asking you approve that the attorney limit please that's the time that's not necessarily to have more people to stay for a long time there to to try to make an approve this that's the time show the people did you respect and show the people that you can leave the this position and pass to other to other leaders in the community thank you are there any more yeah I have

two more Victor and Mimi Hernandez so next is Mimi Hernandez already provided comment is that correct through a written comment correct so I think that um so we have then left with Victor Vasquez yes um Mr Vazquez can you can you speak right now is your microphone open I don't see you oh there you go okay so whenever you start talking I will start the timer sure um good evening boar um I'm here as representative someone's Mayfair and we still believe that this is an important policy to pass we urge you to think about that and and let's figure out a way to create long-term Solutions there's never been about one or two people those are moments in our history that highlight that there's a systematic problem that we have not fixed and as we

move forward I've talked to many of you in different formats we talked about new Alum Rock and I believe that people that believe in new Alum Rock that's Progressive and thinks about alternative Solutions also cannot assume that the status quo Solutions or let's be like other districts is enough for us or good enough for us because us as undocumented people and families we deserve something better so I urge you to think about the long-term potential solutions that could also happen and also urge you to think about this another time and to work together we are interested in working in schools and communities first with you all but I think that would take action and not just resolution so we welcome you in that effort as well thank you very much um were there any others

Avatar I still have that Mimi Hernandez with raised hand s after that one I think I think people are allowed their two minutes and welcome I believe she had hers through her written comment um yeah so I think that's what so um so the interesting Marquez which she's just for sure at the end of the meeting right she's she's not coming back until the end so when we let me um get back to the regular screen um so when we get to item because it sounds like we're wanting to table this item until the end of the meeting in hopes that we give trustee Marquez the opportunity to um come and provide uh any comment that she may want to give um and so when we get to item uh let's see maybe like eight

point like an 8.0 or 8.01 or a consent calendar basically can we contact trustee Marquez and let her know that um ask her if she's if her phone is allowing her to provide any comment on the 5.01 item so so basically what I'm asking is we table it as per the suggestion of trustee Quito table the item until the last item on the agenda on the Open Session agenda and at consent um we contact trustee Marquez to ask if she would like to comment is that okay with everyone does that meet your suggestion trustee Quintero and is it possible Avatar technically yes possible so we will wait for um we will call her later okay is that um to table it do we need to yes oh yeah that's what I intended that uh when

a tk8 school there is no need for board approval CDE already gave us the um the green light and we will be adding uh the Middle School Grace one at a time the same way we follow with Adelante one so this upcoming year 2021 uh the fifth graders in Adelante 2 will be going into sixth grade out of Atlanta too thank you okay thank you um any questions or comments from anyone on the board pictures but you're you sound kind of faint I don't know closer talk a little louder there you go yeah uh just as one of the parents that um founded or opened up that um school I'm very happy to hear that as I know the need is there um and so I'm just you know I I can already Envision you

know the children um continuing to grow with our district bilingual bicultural so I'm very happy to hear that okay thank you any other questions or comments uh um Avatar do we have a public comment yes there is one okay what is it a email or it is in the zoom okay so is that from flor de Leon I see her saying that she has a comment you know this is from Brenda so then we have two because Floyd is also wanting to eat can I see and I'm sure you see it too obviously so um while I get the timer up maybe we can start with Brenda's comment okay okay Brenda you're in hold on let me get a can you see the timer Brenda yes okay whenever you begin I'll start it okay I

just have a quick comment for the Atlanta TK through eight will that have a VP and a principal or will there be only one principle for both schools um I've seen this in other schools and I hope that um we can have some support especially with um when you mix mix middle school with a lower case um level I feel like we need to have a lot of support especially because I know when it's TK through eight um it's not considered a middle school correct those are just my questions and comments and I'm excited that this will happen I just want to make sure that there will be proper support for this goal because I've seen the lack of support in other TK through eight schools thank you thank you um do we floor de

Leon can we open up her microphone Avatar yes Florida can you hear me yes we can you hear me yes so when you start I'll start the timer okay so I just uh had the same concern that I know the arbaque and Adelante basically are in the same location and I wanted to know what's going to happen with the resources that these schools has like for example the principal because I think sometimes when we're trying to make cuts and also the other question is the question is what's going to happen to those kids are all those kids going to be able to be accommodated to Adelante because now we're talking about Atlanta to making a to make it in a tk2a and I um I think it's very important to if we are in a

way that's for me a console consolidation because two schools were there to be able to have a principal and vice principal because I think it's very important to the quality of Education that we're going to be giving and that is one of the concerns I have because sometimes uh yeah the resources are or because we're trying to save and we don't provide the best quality that we can get and I was one of my concerns and I'm just gonna stop right there okay thank you was that it after yes sir okay so let me get back to my agenda okay um so any other comments or questions from board members if not we can move to the next item I'll trusty Chavez can you unmute trustee Chavez after thank you I do agree with the

last two parents that spoke we do need to have uh make sure that there is a principle and a vice principal uh in that school thanks that's it all right thank you trustee Quintero that I see something from you or no comments for me okay so we will move on then here we know nothing further to item 6.02 which I believe will be a brief presentation or presentation from I'm Sandra Garcia regarding vocal control accountability plan initial findings presentation we have Miss Garcia ready to go and doing I think she has the presentation that she's gonna share is that accurate yes so I'm just okay oh unmute her Miss Garcia all right okay can can you all hear me yes okay my is my am I able to share my presentation can you see my

presentation I see it yes okay perfect uh good evening uh president um and superintendent Bauer board members in the community that is on air with us at this time um Sandra Garcia and I'm here this evening to provide an update on the local control accountability plan and our initial findings um first I want to begin with um the objectives for my presentation I I will provide an update from the CDE um for the 2021 lcat development I will share some additional stakeholder input the trends and the findings that we have come to thus far I'll share some survey information and then the next steps for the lcap adoption process so um during this time of school closures uh this we have heard from the CDE that there are some proposals moving forward um to um

suspend or delay the adoption of 2020 2021 lcaps for um the upcoming year um there are a couple of options that are being considered the first is that we continue with the same plan with the ability to make some adjustments in the current plan postpone the lcap for a year is another option that is being considered by the CD and another option is for allies to provide a one-page summary one or two page summary of what their lcap changes will be for the coming year um I'm still waiting to hear more information on this um we hope to hear some information soon and I am just continuing to work on developing what I can at this time until I get further notice from the um CD the State Board uh education you've all seen this

timeline before so I'm not going to spend too much time on it but tonight we are at the board update on April 9th uh stakeholder input this presentation is a synthesis of the input that I've received from stakeholders at our community forums at our school input sessions and input sessions from our other stakeholders such as bargaining units and students and we also have our surveys so we luckily were able to complete our community forums before covet 19. we were just finishing up and we had three um lcap forums at three different Middle School sites and we also had school input sessions and um we had a middle school input sessions at every Middle School this year so this these Trends and findings are those topics that came up frequently during these forums um we synthesize

the information came down to some trends that um parents and stakeholders have were talking about it all of these input sessions and um came down to these various Trends so we have um goal one through goal four represented here and some of the trends that we um saw coming out of these meetings a couple of things that continue to come up are the need for more tutoring for students um more than just teachers tutoring after school but more contracted services and homework clubs and opportunity for students to get their homework done after school um the need for social emotional learning and counseling and training comes up several times in these forums it came up under goal one the need for the training and in goal three under safe and welcoming environment on the need for

more counseling and services um one of the areas that came up frequently which is interesting um since we're now in um using distance learning as a way to um teach our our students is the need for more PD for our staff with the technology and apps that are available for um teaching so that's something that I thought was very interesting that came up even before this situation um so you see there what some of the trends and findings are I'm going to move on to the next slide which is from our middle school students so we wanted to make sure that our middle school students were represented in these input sessions last year we added on a component at our forums where we had a breakout group just for middle school students but we didn't

really have a lot of um participation from middle school students at those forums it was mostly parents that that were coming to those meetings so in our department we decided that we were going to go out to the middle schools and gather information from our students so we were able to have an input session at every Middle School um this year and um interestingly enough a lot of their wants and needs under these goals um mirror what the forums are asking for as well um uh one of the again one of the things that they're really asking for is that um you know they're able to use a variety of methods for learning in the classroom um and have more specialized programs and elective courses but also the the whole need for teachers to be

trained in the different um technology apps and educational apps that are offered out there as a way of learning in the classroom they also asked for more counselors and continue to keep Vapor programs and Improvement of sports programs which are things that are very important to them and you know they they feel very strongly that their parents also need to have training in different areas including English classes parenting classes and counseling resources so this is from our student students at the very bottom there were a lot of comments from students about the general needs of our our facilities so I mentioned it there at the bottom but of course these are not lcap um related items that are paid through the lcap but I I felt it was important to include that just so that

their voices heard so this is broken down by each goal and um it's it's really the same information that I I had on the a previous slide this slide here um but it's a synthesis of of all of it um and this is under L Capital One which is the rigorous and challenging Innovative instructional program so again you're just reiterating the the trends that we found um through this data that we compiled this is um lcap gold too which is for English learners and really a lot of that the trends there were around professional development so that teachers and administrators understand um how to reach our English Learners and how to support them and also the summer programs and tutoring that support those students L Capital three again is the safe and welcoming and caring

environment um goal and you know um all stakeholders Express the the need for more counseling services and that type of support for students and the development of positive School culture is a a current um theme throughout these forums okay yeah I'll cap gold four um something that came up that that was a little new but I think that we um we recognize that there's always new and better ways to reach our parents and let them know about our school events even though they are very well attended we could always have even more parents attending these um these events and um parent trainings so the advertisement and Outreach to those parents um um and the flexible scheduling of events so that there's more access for them moving on to the surveys um this is I just

want to make sure that um we're clear on this that before well actually around the time when we were facing these school closures our family survey was closing up and um we were about to launch our spring staff and student survey on March 16th and that was the first day of our school closures so we've had to postpone that survey so the the survey that's reflected the data that's reflected in these um these charts um is the data from our fall survey for staff and students but our spring results for parents so I I went back and forth about including the staff and students since it is from around November December and it would have been better to have the spring data but I did want to share at least um what these stakeholders were

feeling around the time of the survey in the fall this is an overall um showing the overall results of the four different um uh certain data um for every area so this is um for elementary middle staff and parents in the areas that they were surveyed in and these are the overall results if you see the numbers underneath each of the percentage if there's a red um that is that the the result has gone down by that might that percentage for example under Elementary it says climate of support for academic learning that has gone down to percentage points from the previous time these kids were surveyed which was last spring um and then if you see Middle School for the same area it's gone up one percent from the last time they were surveyed and

I just wanted to point that out so that you could see a comparison from one survey um uh period to the other this is um I what I did was I selected a few of the questions and the results that tie into each of our goals and um this is just a sample of um what our our stakeholders are expressing through this survey so this is um under goal one for support for academic learning um I I chose these questions because I thought they tied in well to um this goal so if you see the data it's broken down by Elementary Middle staff and parents um you know our parents feel very strongly that you know our kids are are really receiving a quality experience in academic learning um you know our staff has very

good ratings as well and our elementary life somewhere in the 70th percentile Elementary 71 in Middle 78 percent dress up this area is for safety and this would fall under um goal three and I selected these areas because I thought it tied into students overall feeling of safety um you know do they feel safe at school um and then parents you know they're feeling the feeling of their child being safe on school grounds um again you know our parents um they if you see the parent ratings it even got went up from last year four four percent from last year and five percent on the second question um and actually the only area that went down was um was the question for staff on a harassment or bullying among students which actually if you read

the question it's asked if there's harassment or bullying among students and the answers are is it an insignificant problem or a severe problem so a decrease is better because they feel that there's less problems this year than last year close enough it's another area which I believe also um ties into um the whole area um a feeling of safety but also parents feeling connected to the school um and students feeling connected to their school and this is an area that I think probably rated the the lowest among all of them um and the question for the elementary is I feel like I'm part of this school um and and um the middle is I feel close to people at this school but again the parents they feel very connected to the school and I think

that that really shows the um the way that we try to involve parents in our school community and get them over to um to join with us on different activities and and Leadership opportunities staff ratings um are also you know 87 for this school is a supportive and environment inviting environment to work in and then the relationship between staff members foreign and again if you see the green in a few areas there was an increase in a few of these areas so when it all comes down to it and looking at the data and and and talking to several parents over um the three forums and in the DAC and the d-lac and just listening to parents from across the the district and also you know thinking about our budget and how um you know

we we probably don't have an opportunity to increase any of these services but we definitely have an opportunity to look at these considerations and think of how we can continue to improve in these areas because none of these areas are are new um trends that are are showing up these are these are things that you know we are have already begun in our district and these are opportunities for us to just continue to look at things to improve what we're doing and make things better for our students and families so you know in a couple of areas I'll pick John in the support for academic learning again is you know continuing with the development of the SEL program for increased student support and the other one I would think about is you know consider ways

to incorporate a wide range of Technology apps platforms as learning tools which we're seeing now that the work we've done already is really benefiting us through this distance learning time that we're in you know because if we if we hadn't done the work we've done in this area already we would be further behind than we are and I think we're in a really good place um as far as safety I think it's important to look at building out our district STL plan which I know that Dr Amazon is already really busy working on and working with her committee on um I think that that'll go a long way and um some of the needs that our families are expressing and then the school connectedness is just to continue to build a capacity for Meaningful parent

engagement and our parents foreign I would share updates with my parent advisory committees and continue the process um I am going to continue working on these things and finding ways to um to continue this process until I hear otherwise and I will continue to update you um with whatever information I received from the CDE in terms of our lcap timeline that's it okay thank you very much um [Music] are there any I guess we'll start any questions or comments from from the board trustee can we unmute her after and make sure you're unmuted yourself there you go yes okay okay uh so thank you so much Sandra for the presentation um you kind of answered a few of the questions I had in regards to the survey um the surveys the outcomes on page 12.

um I did see the fall in there but I wasn't sure if there was uh initially planned to survey our staff and students again and possibly even families because I did notice um you know a difference of 1 341 um less participants from 2019. so I think you made it clear in that the family surveys were done but the staff and students were not and then I also I heard you say at the end of the presentation that you're going to continue um and unless you hear otherwise from the state um so I might correct to um to with that comment being said uh take that you are going to be serving staff and students Again by the end of this school year can can you hear me yes go ahead okay I've been talking

to the principals about this and we we definitely have the the capacity to do this um I kind of wanted the distance learning to get off the ground so that we're not bombarding people with a survey on top of what they're doing at home with distance learning I do have a couple of concerns about students taking the survey at home without the guidance of their teachers because a lot of times the teachers will prepare students and let them know what the survey is about the importance of the survey and why they're taking it but we definitely do have the opportunity to give this survey through this you know the distance learning that's happening at home so I I definitely um can still give that survey happened was that a plan for our staff oh yes

it was already it was set to launch on March 16th and that was the first day of our shelter in place at home so that's why it was postponed for for a minute thank you okay thank you any other questions or comments from the board yeah okay trustee Chavez and just I'm sorry before you start um public if you are wanting to provide public comment on this item please begin either sending it or raising your hand or whatever you need to do to um to make yourself to get yourself noticed so that we can get you called trustee Chavez so if we postpone like at the beginning Sandra said that if you know my people spawned or or if they actually do it you know during this you know next couple of months um what

what does she suggest would probably be the best outcome if either we postpone it or we do it within a month or two [Music] I think I'd like to talk to a couple of principals and um maybe we can and probably Mr Sanchez be involved in the conversation to discuss how what we think the reliability of the outcome will be um just because it's it's going to be given in a whole different um way um but I mean I I definitely can give the survey still that's why I said postpone and not canceled um I still think it's important to get the voice of of the students and the staff for the spring and and it would be good to compare the two all right I have one additional question um do you see them

responding way different and the needs are probably going to be different if we do postpone it and and maybe we can go ahead I feel like maybe there's going to be an emotional you know peace to this as well you know they're students and staff may also be feeling insecure with the whole situation we're in so I I really feel like that might affect the results um but we definitely we definitely could give it and just kind of just have that in the back of our mind that you know the results may not be um as reliable as they would have been if they were given in the same context as before yeah thank you thank you any other questions or comments I just had a simple brief question um um Sandra on the the

items that have column like goal one goal two goal three go go four in the different areas and they're numbered like one through ten down that column is there any um order of of those or are they just kind of randomly put in those boxes good question those are the those are the how they appeared what appeared the most so the number one was a what appeared the most commonly as a theme okay and so um is was there like a threshold of com because some of them have you know nine items some just two so was it like the top I'm just trying to get a sense of how many what made it into the themes and what what was the threshold of things that maybe didn't make it into these um theme so

what we looked at were um things that were mentioned more than five or six times so all of these were mentioned more than five or six times we didn't include things that were maybe mentioned a few times and I mean I definitely have all of that data but um it would have been a really long list to include there these are things that were mentioned several times thank you and I also just wanted to briefly thank you for the presentation and and the you know the the thoughtfulness and the and the formatting it's very easy to understand and it's very easy for us to to get a good sense of of you know the work that's being done trustee Chavez after this um uh covet 19. I think uh the first and second goals have

changed drastically I attended the the lcaps and I mean after seeing all of this everybody's in shelter um I think if we were to ask the parents now as far as the learning goes I think that they're going to have different goals now because like a lot of them you know Ernest tech savvy as they should be maybe that's going to change that they need to be more the parents need to be more tech savvy so that they can you know help the students you know at home and and they need to be able to get up on the computer and be able to help their students their child that's it that's that's all I have to say thank you any other questions or comments yeah we have a few are they Zoom or emails

or what how are they coming in so there are um four on zoom and there is one through email but it is not related to this item okay so just for zooms um okay so you can begin to call them and if you are providing public comment through Zoom one oh I gotta share my screen First Once you um begin talking I will start the clock once I get it shared with everybody can you see that can you see the clock yes okay so after whenever you get them in and they start talking I will start the clock sure the first person is Victor I just want to start off by saying thank you senator for providing the update and also looking through the results and creating ways to continue to create new ways to

engage students and and parents and I want to thank you for that and I would just want to share with the board that you know please consider us an ally in looking at alternatives to discipline and systems in that area we have staff members who have different Masters and practice degrees around those areas outside in our other departments that are more than willing to support in The District in in developing those strategies and Frameworks and then the other point that I wanted to to look at is has the state given any lcap adjustment timelines given this covid-19 given that the lcap budget is part of uh it's needed to be approved as part of your overall budget so I'm wondering about that um and lastly I mentioned earlier that schools and communities first is a

ballot initiative that seeks to provide additional funding for schools 40 percent of the funds will go back to schools that like we all know and also want to consider us as a partner given that a lot of those funds are going to be going through the lcap funnel system I guess or redistribution system and I'm wondering if if at some point um this board is also interested on an individual capacity or otherwise to work together and making sure that something like that is successful uh this fall I know that other border board members are heavily involved with this schools and communities first because it ties into the lcap and provides more resources so I'm just putting that out there and considers an ally in terms of getting more resources through that valid measure thank you

thank you okay after our same thing when you're ready with the next one and they start talking I will start the clock okay the next person is Brenda hi can you hear me yes hi uh thank you Sandra for your report um I appreciate everything you do um I do have a um maybe a suggestion if you do give the survey to the students uh maybe this month or whenever you guys decide I think it would be a good idea because maybe you guys can get some of the emotions that kids are going through maybe uh ask a question or we also don't know if there's kids that are not safe at home and this could be a good way to get that input um we could ask you know as well as has it

been hard to be on technology or what are the challenges I think this Civic we can I don't know if you can add questions but it would be a great way to get um a lot of answers from our students and I think that a lot of our teachers are on Zoom can also explain this survey because well I've had a great experience with the teacher and he's been very good with explaining the everything to my son so if you do consider doing it I'm just a suggestion thank you okay the next one Maria Martinez hi can you hear me yes yes okay thank you uh thank you Sandra um for this information uh but my comment is about the gold tree I know a lot of parents they they we um asking for camera

for security but that one I understand the air cup is for conducted to learning and and um I don't understand how can the camera for the security that's conducted to learning for our students also the the custodian and uh in the Improvement for the school facilities I know we have another uh uh another brands that they can use it for for these uh Point uh hopefully you can uh improve this and get more like um counseling for for our students and also I think that parents we need to get access for this uh counseling service uh especially in this moment to prepare the button how can the uh get to help the the student to be prepared for the next year um that's what might come in thank you thank you so next one is

dilsa Gonzalez okay hi good evening uh thank you Sandra for such a true um explanation on the El Cap and the parents that we have been doing especially on um looking for ways on how to involve our middle schoolers I I am glad to see that um even though we have some students that don't feel safe or are not feeling connected the majority of them are doing that so and I just want to applaud that is because of the PBIS training social emotionally and I'm restorative justice work that we we all have been doing from that staff to um to the counselors into the different organizations such as faces almost and other people around here so um I just want to uh continue this work continue research Justice continue PBIS and social emotionally um programs

for our students that we see that are working that we've seen that are low in our suspension and um as Victor said uh she asked the parents also as allies to work on Alternatives and better solutions to bring um to lowering the suspensions and lowering other other things happening in our schools um thank you very much let's continue working this is um what we are all working together and keeping communication and um I can't wait to see what else we will be able to accomplish when we work as as one and we work as a team for the future of our students have a really good night thank you and the next one we have is Olivia Ortiz okay you hear me yes hi well first of all I want to thank um Sandra for

doing the amazing job that she's doing uh I I think it shows the results of how working together you know the whole Community together um we have amazing results uh we uh I'm part of the of the sub El Cap committee where there's teachers as principals involving that committee so I think this is I just wanted to mention that because I think that's what we all need you know I I'm also want to um comment on how we are getting our students engaged uh hopefully we can get more students out there to go to the community forums but um I'm really happy that we get in our students special middle schoolers uh I think we have to learn a lot from them because they're the ones that they go through school the whole day and

they experience it how school is doing but um let's keep working together uh Sandra thank you so much for for doing the work you do and you know setting up all those meetings and sending the emails uh yeah thank you thank you and we have one more is floor delium okay can you hear me yes okay so I just want to Echo what uh the other people had say and also what Sandra just has presented and the results that came out that uh more people wants to see um uh restaurant to Justice programs homework class tutoring uh which we know it's very important and I I talked to a lot of parents and uh a lot of parents uh see that tutoring programs uh and I give an example in Renaissance they are doing the

attorney programs and it has really helped my kid a lot and I think those programs should be and other parents say why these schools have these why not my school you know and I think it's it's in a way of prioritizing what the people is saying and all what uh Sandra got in the in the information that that she got with the forums unfortunately a lot of parents don't didn't participate I didn't see a lot of participation I think I saw more participation last year and I know Maria mentioned something about the cameras and I and I've been in I was in most of the forums step one and I noticed that that every Community is a little bit different and I know in Shepherd there were a lot of Asian community and they were

putting cameras but I think sometimes it's a misunderstanding because when we give get this input from that Community we're only giving getting pulled from the l-cup funds and I think a lot of people get confused because they they say we need facilities we need we need cameras we need these but they don't know that Alka money is this money for low income foster care English Learners and we know that a lot of our populations are kids that um are under this category but I think it will be good to to give people also that these kinds of photos to get more important General funds how do we spend them because we don't want to get this money on resources that are not supposed to be because how a camera is going to help these type

of kids and I think security is important and counseling is very important I think counseling is more more important than having police officers in campus and maybe Security will be another I idea of getting that type of security Ernesto is mentioning thank you okay was that it after yes sir okay thank you everyone can I just one more comment please I just wanted to let the um the community know that the uh presentation was translated into Spanish you can find it on our um District web page perfect thank you Sandra um okay no other questions by trustees um we will move on to item see that was six Marcus has common hello can you hear me trusty Marquez you we were able to hear you we're being made this whole time that it came on

um is there a reason why before I cleared now and again I had you right in front of my speaker Okay so I could not hear um who was making comments and and the subject matter and um what item is that we're on we just finished the l cap as I mentioned to you when I call you okay still on it or are we done with it did they already it's information only but if you have a comment or question we can take that now can you hear me yeah then I can just do that right now yes um on the accountability here it's the initial sign is this correct yes okay and the initial findings are all based on what the surveys in the community forums there is a presentation that isn't was shared

with every trustee in your pocket yes and that's what I'm looking at so um I I just have um I'm having a hard time with this one because um I thought that in the presentation um there would be something more substantial instead of instead of giving this um this report on just on the surveys you know um there is no other instrument that would collaborate the findings or anything like that is very subjectable as to um the findings and where we are with this so I'm really you know the forums I know when I went to them in the beginning they were very poorly attended I saw lots of staff and very little parents and then when I did go back it was almost the same parents with a few new ones from wherever the

sites being held at on the forums I was just really hoping that I mean and the findings would be done within this instrument that would really do measurable um findings for us so that's all I have to say thank you okay any other questions or comments no other than no yeah just um just my comment about the how this whole thing was put together on the uh I'm very disappointed that it's just done on surveys especially Marcus um was asking the rest of the trustees oh okay and um I think I just a brief response to that I do um I do believe from what I can tell that the the methodology for um what we've been presented is looks fairly rigorous as far as I could tell um the the N or the total

number of surveys that we received is is um is significant um fairly significant I at least in my estimation I know um if I'm am I correct Dr Bauer and that Dr almazan also is has been working on this that was mentioned and I know she's he works helps to do some of this work is that correct yes everything is in the present person so so I um that being said I know the good work to Sandra does and Dr almasan were given her you know her background as well with in terms of research um and putting this stuff together so I'm comfortable with it but I would also um if you do have concerns trustee Marquez I would definitely encourage you to voice them to to the team so that we can either get

your questions answered or or have it addressed and you know the methodology as we move forward absolutely thank you uh trustee Chavez yeah I did attend the lcaps meetings couple of them and they were very well staffed with Alan Rock staff there and they all broke up in groups and um in in each l-cap I I noticed that websites the parents had plenty of time to know where the cups were going to be there's a few there's I think maybe maybe one that did get canceled but as far as them having the other ones um the staff did a good job in in asking questions and breaking up into groups so that was my experience in this year's all cap okay um anything else if not we can move forward I'm just trying to keep

an eye on the clock here we have uh that's item that was 6.02 so we can move forward to item 7.01 regarding resignations information only is there any public comment on this item Avatar no there isn't okay any questions or comments from the board men okay um I'm just going to give it a very brief second for any YouTube lag comments that may come in this is an informational item so we do not need to take action um assuming no comments we can move forward to item 7.02 uh classified School Employees week May 17th through 23rd um any comments or questions from the board move to approve uh I thought I heard a motion trustee do you have a comment or uh you have a comment but I can second that and then comment perfect

I want to really highlight you know we already highlighted all of our stuff but I know this is a resolution um for our classified School Employees um which we usually celebrate with a you know yummy uh gathering with food um and really you know thanking them in a personal way I remember taking beautiful pictures last year and things like that unfortunately this year might look a little different but just really want to highlight everything they're doing uh you know everybody our custodians out there our cafeteria workers I mean I don't want to miss anybody out there's you know many many many of them that continue to do the essential work that our schools and the community needs I've been able to go out to all the sites um at least once you know that are

providing lunch and it's just great to see you know the uh the smiles that these children even from the car get you know when they see their cafeteria you know lady or uh the custodian crack a joke from afar you know every every every uh energy you know whether it's putting a bag of lunch together or just being present um matters to our community so I just really want to highlight that and acknowledge them for just their person and also going above and beyond during this time and also sacrificing time with their families you know and being outside of their home to assure that our children have what they need during this time thank you thank you I I actually wanted to um pretty much Echo what those comments were again thanking um our classified

staff for their service I think as as Tres Diego alluded to in many ways are classified staff is really the backbone of our district a lot of what you know our our teachers and everyone need to do couldn't happen if we didn't have these these staffers doing the work that they do day in and day out um so I exactly had the same words you had about going above and beyond stepping up to the plate without a second thought in many instances in this challenging times that we've been having um and really just you know no questions asked what do you need how can I serve how can we serve our families and that is definitely appreciated by the community and by all of us so um thank you to our our classified staff any

other comments or questions from board members none for me all right um any public comment no naftar I'm assuming none okay um so we have a second and emotion of a motion and a second on the floor to approve the item I'll call for the vote individually um trustee Chavez hey that's a a yes for trustee Chavez um trustee yes I think I heard is that correct okay trusty Quintero uh trustee Marquez yes and myself yes unanimous uh resolution passes okay we move on to the consent calendar um is there before that anyone makes a motion I just want if well first of all is there a motion on the consent calendar hey what about uh 702 did I skip something the classified School Employees week we just wrote it oh sorry about that we

just did did you have something else to add to that trustee Quintero are you just highlighting that we don't forget it okay no no no okay so if I'm correct then we're on consent calendar is there a motion for the consent calendar see if we can put them all together with the exception of the naleo 808. so 808 can we pull that one for discussion but if we can approve all the consent calendar as is okay and I I actually want to pull out 801 806 809 and 810 okay so 801 you said 806 809 and 18. and eight ten yes okay any other so we have 801 806 808 809 and 810 anything else 802 you said okay any other I'm sorry not 802. I think you're already um 80. 803 we do not

have that so 803 not 802 so 803. got it thank you um anyone else Okay so it looks like the motion on the floor correct me if I'm mistaken trustee Chavez is to approve the consent calendar with the exception of 801 803 806 808 809 and 810 correct okay um is there a second to that motion like trust okay um so um let's see trustee I guess I'll call for the vote oh I'm assuming there's no public comment on this um it's correct Avatar all right I think I have to ask for it every time still so um trustee Chavez yes okay trustee yes aye trustee Marquez yes and myself I so that's unanimous approval with the exceptions noted so 8.01 I did have a couple of um items that I wanted to pull or

add for amendment that I will send offline to Maribel um regarding the special board meeting that we had um and that was January 21st in particular it was [Music] um well I'll I'll I guess highlight it at the next meeting when we when I make the amendments um so that's it for that one I will have amendments to item 1801. I'm sorry I couldn't hear that I said what are you gonna approve the um that's right we have to do the um actually I had a item on the on um number eight the super under the superintendent Boardman business on February on the February meeting on the second paragraph So we have um modifications for both the February and the special board meeting did you want to do it now trustee or do you want

to listen to Dr Bauer and I can I already mentioned it okay so it looks like we will not be approving tonight quite yet these um the minutes for either February or the special board meeting correct will either send or confirm the receipt I've already sent Corrections okay um item 8.03 trust theater lower I believe you you wanted to pull that one just Rose uh Jordan three um didn't mention them to Dr Bauer I know a lot of these um uh fundraisers we had prior to cover 19. just wanted to put in public that obviously you know some of the dances that were scheduled for the end of the year we're Sheltering in place so there's no way that as a board we were we would agree to have a dance during that time I

just wanted to make sure that we mentioned that out loud during this meeting we could approve a zoom dance he's going to prove a zoom board meeting dance but yeah other than that I'm good with it so um if I can move to approved um okay there's a motion in a second to approve item 803 any discussion or questions from the board see none any public comment Avatar none none okay we will call for the vote on this um trustee Chavez yes trustee Quintero yes trustee Marquez yes and myself yes unanimous 803 uh motion passes um 8.06 um this is a a brief one as well um just wanted to be clear and make sure you call it out so there's an item on 8.06 Tran Education Services um for painter Elementary and it's um

the the name associated with it is the print our principal um Lee Tran so I just want to make it clear and transparent I'm assuming there is no I know it's a common name but I just want to call out that there's no relationship between the um the Tran Education Services and the principal can you um anyone on staff confirm that there's no issue there it's like us with martinez you know but yeah there's absolutely no relationship there that's what I pretty much knew but I just wanted to know if you're not the only one that's fine okay so with that I will move to approve item 8.06 second okay there's a motion and a second on the floor to approve it any discussion or questions further from the board okay Avatar any public comment

on 8.06 uh really quick um sorry for coming in late um but uh I just want to um recognize that um the great work from staff for partnering with folks like the city peace project they're going to come in and do some amazing work uh that they're doing all over the city uh to go ahead and promote pro-social uh type of behaviors in our district and so very excited to see that that partnership continues just wondering briefly mention that all right thank you so we'll go ahead and call for the vote trustee Chavez yes trusty Quintero yes um yeah trusty Marquez and myself yes unanimously 8.06 passes um 8.09 I just wanted to call out this one because as we know um along with everything else in these challenging times you know are are Asian

Asian Pacific Islander brothers and sisters as in our community in our district are facing some unfortunate difficult actions in in the public you know not only in our district but everywhere and I just want to call out the um obviously the the rich Heritage of all the different um groups that we have contained in Asian Asian Pacific um in that classification and also acknowledge that these are our are you know part of our Alum Rock Family part of our Alum Rock Community and we should in spite of you know everything that we things that we may hear or see remember that we're still just part of one Community here and and recognize that with our um Asian Pacific and Asian Pacific Highlander Community um so I just wanted to call that out in these times

any questions or comments from um board members okay any public comment after hey dude I have a comment sorry about that can you hear me now yep yeah I know I just want to join you in your in the comments that you made that uh it's unacceptable to go out there and um attempt to uh pin some natural thing on a particular group of our society and then now we're seeing all these attacks that are taking place and so um I think that it's a timely that uh we go ahead and adopt this resolution um recognizing the API community and look um looking forward to the time when we can stop these this irresponsible behavior and horrible horrendous behavior on the part of certain folks to uh use uh something as natural as a as

a illness to try to attack a particular community so those were my comments thank you anything further from board members okay so that being said I'll call for the vote for item 8.09 um trustee Chavez yes yes trustee Quintero yes trustee Marquez and yes for myself unanimously 8.09 passes I believe I've skipped 8.08 I apologize for that um but we can go back to item 8.08 and trustee Chavez um you wanted to call that one out yeah um I wanted to know is that total is that over the the usual trusty stipend or is that in addition to how is that you're talking about 808 the amount yes yes it's within her it's within the trustees uh amount okay okay anything further on that by trustee Chavez or anyone else [Music] and I want to

say something more uh trustee Marquez very nicely asked me yesterday during our one-on-one superintendent what about this and I encouraged her and I told her let's leave this I'm trying I'm hoping because it's so far ahead of time and because there is absolutely no risk of losing any money uh hotel and airfare are totally refundable as well as registration there is really no risk for the district to lose any money over that and because of that I support it uh to keep the item on the agenda she did request she asked is this something proven to do and I told her yes I want to make sure that all of you know that thank you okay any other questions or comments from trustees just to come thank you um avtar any public comment on this

item none all right I will go ahead then and call for the vote on item do we have a motion in a second no huh to approve the um 808. we have a motion from second I'll second it so second from me um so I will call for the vote on item 808 trustee Chavez trustee Chavez your vote on item 808 we can't hear you if you're saying anything I still can't hear you if you give a thumbs up or thumbs down I'll repeat that um because Christy Chavez are you answered okay you're open okay pass to the next one I'm still trying to decide well this we have a motion and a second on the floor right now let me um you mean pass to the next person okay I'll go to trustee yes

okay trusty Quintero yay trusty Marquez yes myself yes trustee Chavez yes okay unanimous five nothing motion passes sorry just one second since it is for Marquez you should be should she be voting on items for herself questions so um question I would say that the same thing in this it's only a typical board expense for professional development but I would say the safe thing is for her from this phone it's for her I'm assuming you said recuse but can you confirm that yes recuse it's not compensation but I would recommend that the safe thing for her to do is just to recuse herself so do we need to retake the whole Vote or just have her recuse herself just have her say that she's going to recuse herself she's withdrawing her support okay do you

hear that trustee Marquez yeah for doing my job so um it this is not setting a precedence I mean I don't want to set a precedence where we all have to vote no um Andrea Andre my colleague here who's been here the long you know second longest than me he's voted on these items for he's gone to naleo's and it's passed and even his vote was in there um so I I like to challenge that for a second opinion because there's no no financial gain here just like I said yeah yeah I don't excuse me I don't think it's mandatory I was just recommending that it would be a safe thing to do but I don't believe it's mandatory because you're right it is not compensation it's only an expense for professional development okay um

so let's call for a little man yeah at this point we've already we've already called for the vote we've had discussion we've we've had a vote and so since it's not mandatory we will go with the the votes that were cast and move forward with the next to the next item can I make a quick comment because quick yes okay because the way it was written it made it seem like it was in addition to the 5 000 and in personal development I believe that it shouldn't even been on here it should have just already been approved she shouldn't have had to go through this so for the future if it's under this this stipend or whatever amount we're allowed especially for instance since it is for development I don't think that we should have

to bring it to the board for you know for our approval I think it should have just been approved from the get-go uh trustee Travis I'm sorry to jump in it the reason is brought to the board is because it's out of state and all travel out of state comes to the board oh okay yeah that's it I'd say I didn't know how to vote on this because of that time okay okay thank you for that point and and answer okay and you had to pulled item number 10 correct the oh sorry I'm I have an old agenda so okay cool all right did you have a comment on 810 yeah I do okay you can you can go ahead and make your comment oh all right on uh the talking about Cinco de Mayo

week yes to make sure because I got an old agenda I'm trying I'm looking at the new one that's correct resolution Cinco de Mayo week May 4th May 8th 2020. go ahead so uh with regard to the uh Cinco I'm uh excited that uh we're going ahead and um approve this resolution I want to make sure to mention that uh the erroneous thought that this is a Mexican holiday um I think was uh um um done away with under David Hayes Bautista's uh amazing piece of work as people of my own American tradition that clearly outlines that in Cinco de Mayo happens to as it's celebrated today happens to be a us-based holiday uh that has its roots here in people from the southwest primarily that were fighting against uh the oppression that was coming

in from the southerners who wanted to maintain this tradition of slavery and so we have here in San Jose um individuals who had just been a couple years prior um you know scan a couple years prior had citizens of the United States uh had out were now uh coming forward and enlisting people uh to go ahead and serve as uh and serve in the service of the United of now the United States and so we have Captain Jose saying these words as he's uh attempting to enlist uh uh Native California and California to a Cavalry and he says sons of California our country calls and we must obey this Unholy rebellion of southern states must be crushed and must come back into the union and pay obedience to the Stars and Stripes United We Will

by force a circumstance become the freest and mightiest Republic on Earth all right so obviously he was uh he he was committed to to the cause of uh moving forward against slavery and in the same time individuals from some will say we're leaving down south to a fight against the oppression that was coming in the form of the French attempting to bring this old European model of monarchy and that type of stuff and so I know that I said this in the past I got some new board members so I got a new audience at least on the board uh and um I'm always trying to make sure that I can be that message that Cinco de Mayo is a genuine uh us-based tradition uh the first uh celebration real serious celebration I think I

was took place in L.A with both veterans from the uh the the Mexican war against the French and then the veterans from the Civil War we happen to be a bunch of Latinos um so that was just my my two cents all right that's much more thorough than the comments that I pulled it for um but so just to clarify so are you saying that it's kind of a dual celebration between la bataya de Puebla and um the other part of it that you mentioned which is kind of newer information to me regarding the slavery the name the name is taken from they had a date um but they were celebrating both the the involvement of these primarily Latinos that happened to be Mexican and Chileans and all kinds of people that came with uh

they were already here in the United States as part of the they came in for the gold rush and so they were all involved in both the the the primarily the Mexicans went down south and they were fighting um the ones who went down south permanent Mexican but the there was a bunch of Mexicans as well as other Latinos that went and jumped into fighting Confederate forces that were making their way through Texas into New Mexico and and they were very successful at pushing them back so they used a name but uh the the the the the what they're celebrating is fighting against the forces of slavery and then this old European mentality of monarchy and that type of stuff they're they're progressives in their time well thank you for that clarification and thank you

for bringing that up I think even in board meetings it's um it's a great opportunity to to Really educate about culture we talked about our Asian Pacific population and and this comment is specific to um our Mexican or apparent evidently also other Latino um people but the comment I wanted to make was more in relation to uh the bataya de Puebla and and just for anyone who knows about it and trustee Quintero has explained already enough but it's um an under-resourced group of individuals fighting fighting against a larger more well resourced and funded Army and and coming out Victorious and and I think that's um to me I kind of that was significant to me and I wanted to call it out this month because I I feel like our community in many ways that

we are you know we're under resourced and and you know we have the challenges that we have within our G geographic location just in terms of the socioeconomics but in this situation against kind of All Odds we've still been able to to serve you know our families to to provide them with meals to to get technology going to get learning going so in many ways the way that um the the Mexican Army was able to fight against and defeat that that bigger more powerful more well-resourced Force I feel like Alum Rock I'm trying to draw the parallel that we are symbolically I think fighting a similar battle um and winning if you ask me so is my analogy historically close trusty Quintero oh spot on man all right thank you so that being said I

thank you all for your um patience with us and and listening to that any other comments from the board or questions any public comment I'm assuming no because Avatar is not there and I don't oh wait let me see I see oh no that's an old yeah no comments okay so we will call for the vote on item 8.10 trustee Chavez yes yeah was that yes yes I'm sorry there was no motion I moved to approve okay Motion in a second um uh let's see trustee Chavez yes what was that interesting I just needed a clarification on what which one it was 8.10 Cinco de Mayo week Quintero yes trustee Marquez and yes for myself unanimous 8.10 passes um those are all the ones that we pulled yes okay so we had an item tabled

I believe that's the this is the time correct am I missing something nope yeah okay so we had item 5.01 table for the purpose of allowing um the space for trustee Marquez to provide comments or ask questions if she still wishes trusty Marquez can you hear and would you like to provide anything there was a couple of requests from the board that we allow you the time the opportunity to make any comment or question that you had just because at that time you were having a lot of problems with or we were having issues with the technology and we just wanted to make sure that we didn't even though we had a quorum it's it's a important item and we wanted to make sure we gave you that opportunity if you wanted it have touched

on that also but um I I just remember hearing rogelio's voice but I did not hear what his comments were and that was pertinent for me I wanted to hear what he had to say and um and I know that I started losing almost everything in the middle of Josephine Dental's comments so um I don't know what I could add to it other than it totally changed I went on the record in February I guess it was when was the last time we were dealing with this one to say I I don't have a problem with you know with the um the term limits on there but at the time they were talking two years they moved it to three years I'm not in favor of the three years you know um people wanted to

make a statement about and I'm sorry trusty Marcus just to be clear you say three years you're meaning three terms of four years right and you know two year two two term limits um made a statement three terms I'm here for three terms already I'm finishing up my I mean that is like saying nothing because after you do your third term you're ready to move on um so um I that's why I'm I I'm so uh I wish I so wish I would have heard all those comments so I I don't know where anyone stands on this issue except for um um my colleague Herrera so I don't know that's all I have to say on the subject I think I stated at least for myself I stated that I would not be supporting this

because of okay a number of reasons but primarily the the financial situation that we're currently in with all this craziness and the unknowns in the future financially just think we need to okay that's your comment okay that's fine we just want to make sure you had that opportunity um so at this point we will hey really quick I just I wanna can I can I make a comment yeah you know I know that uh I want to speak I've already spoken to the issue but uh I also wanted to speak to the fact that um a lot of you know there's a lot of passion and I very much appreciate the passion but I also want to make sure that we're we remember that um you know there's this free exchange of ideas and um

and because uh for some reason or another this time we're not in agreement due to this and as I expressed uh due to circumstances that are out of our control um I just want to make sure that we're we're all um remember that uh Regional people can agree to disagree um in this case as I mentioned it's based on uh information that we received I believe two days ago um and it's information that we didn't have previously which give us a very very dire picture um this is a free exchange of ideas is important it's an in it's in it's a very very important component of our of our democracy and the founders went ahead and they they really recognized the Federalist 10. James Madison went at length to talk about factions in this case

I want to call infections I would just call it differences opinion and that's what he was referring to as well these people who hold differences of opinion but that ultimately have to work together to make things uh work um just as other Wonder homes he States in in a descent it's about when I'll change it I'll paraphrase it to make it more appropriate for our times but when when people have realized that time has upset many fighting Fates they may come to believe that even more than they believe the very foundations of their own conduct that the ultimate good desired is better reached by free trade and ideas and so I think that at the core we all have to remember that we can agree to disagree it doesn't mean that one individual is horrible

and the other is better we just happen to be having to weigh out different things and uh we have a certain opinion that sometimes may not concur for my in my case I've mentioned that I still stand by what I had what I had stated before I only need to make sure that our finances are going to be uh or can withstand such a big commitment of the general fund at this moment and um that's it right or were you going that was it okay okay and I want to actually thank you for saying that um just because I also want to reiterate just that um you know the I understand the comments and and the sentiment that that we're not listening I that's a I hear that very clearly and people feel that that

we are not listening that we've been coming and talking and that we're just not listening and I would I would just disagree with that because I'm listening very strongly to everything the the reason why we are you know having five and I don't know how many three four five ways for public to participate whether it's text or email or Zoom or raising your hand or all these things we're doing is because we want to listen the reason why we have a YouTube Spanish channel is because we want to listen the reason why Dr Bauer has created a group of parents to get feedback about where we're doing all these things we're doing because we do want to listen and we do I know I've mentioned this um in in separate meetings and publicly I do

take um everything that is said very seriously and and I listen to it whether people choose to believe that or not or think that's true I can't change that but I do listen um and and I really do believe that I could be mistaken but that trustee a large part of her bringing this is because she too is is very closely listening to and wanting to bring that voice so it for me it's not that I'm not listening and i i people can say how they choose that's fine but I just want make it clear that I am listening I just have a different opinion and that does not I mean I I defer from there to trusty quintero's comments um so anyone else with questions or comments trustee Chavez yeah um I'll also add

what I said um I wanted to actually amend the motion because uh I do believe in term limits but I don't believe in in the district paying forum and either way whichever way we vote if the community gets the resolution on the ballot Alum Rock has to pay if Alan Rock puts it on the ballot Alan Rock has to pay so I wanted to amend the motion but um it hasn't been amended but what I stated was I would like to amend the motion to include that no expenditures disbursements resources staff time will be incurred by the Alum Rock District in putting this item forward or on the ballot the reason being is because um with everything happening um there is money but there's not enough money and now with um this coronova virus there's

going to be even less so do I want to spend on this right now no do I think that we should spend on this now no um in the future yes but not now right now we need to use all of our resources wisely thank you that's all okay so you're just to be clear you're not putting any Amendment forward at this time no I'm not because we still need to vote on the other ones what I was told yeah well we um from what I understanding from Council previously is that any way you slice it the district Bears the response the financial responsibility of whatever decision is made yes um so that being said we can is there any oh trusted I was gonna say let's move forward with the vote I think I

declare I've said pretty confident that people heard it they need to rewind it they will um so I think if we can go with the vote I know there was doing we don't need to motion and second again right I think it's out there already let's just confirm Maribel is there a motion in second on the floor okay so there is a motion um to approve item 5.01 and and a second to that so I'll call for the vote trustee Chavez no trusted yes trusty Quintero trusty Marquez no and myself no motion fails okay so we can move to [Music] um at this point close session so I will read the way I think I mentioned in the beginning but the way closed session will work is that um I everyone all the trustees have

the link already correct to the separate Zoom meeting for closed session um president just one reminder I don't know if there are any uh any desire of other items on for the May agenda uh it was yeah it was requested to wait through the meeting to see if there was going to be a desire for other agenda items and I just remind you thank you so is there any trustee challenge you had brought that up and and so does anyone else have any items for an agenda future agenda uh and I do have one something in closed session but I'll take that offline so um not particularly on the next agenda but in a future agenda um and this is related to um indirectly I guess to the item that we just voted on in

that um my understanding so Alum Rock we have a in our policy that an item can continue to be brought to the board and suggested for a future agendas um as long as it's within the the I forget the proper terminology but it is reasonable to to the business of the district I'll paraphrase then it must be put on the agenda every time it's brought up which which theoretically allows someone whether it's a board member or Community to just continue to put a a version of something that doesn't pass on the agenda continually until something passes um and my understanding well I know that csba recommends that the the the superintendent and the president of the board at the time be able to have discretion on the items that go onto onto an agenda my

understanding from Mr Ruiz a legal counsel is that he that is his recommendation as well that we allow for that whether it whoever the president may be at that time working in conjunction with the superintendent to to bring items to the agenda in order to expedite the the business of a dis The District in a very in the most efficient way trustee I mean Mr Ruiz can you confirm what I that what I said I hope you're still there and you can hear me I know and yes okay I'm sorry I got disconnected for a second there um yes your your description of the board policy is correct and this District's board policy also differs from the standard form EA form of policy on this issue thank you so um I will be working with

talking to staff and seeing if that that may come I may request to bring that as a reading from our policy to to re-look at how we do that to conform with csba recommendations recommendations from our Council um and based on recommendations from evidently how um how it's handled in in most areas so that's the one item trustee Chavez uh yeah when Mr Reese was talking um it sounded weird and I didn't get to hear anything he said could could he restate that please so uh the board president's description of the of Alum Rock's board bylaw on this issue is accurate um it's also true that Alum rocks by law differs or diverges from the form of policy that's recommended by csba and also by other districts as well the csba form is widely adopted

by other school districts well I mean we don't need to go into it any further it's not an agenda's item but that will be something that I will most likely be requesting for future agenda any other items anybody wants to put okay I don't see anything Ernesto yes are we on um number 12 already is that what I'm hearing yeah I mean we were just circling back remember in the beginning we asked for it and we said at the end we would see if there was anything else for the agenda items yeah future board requests are we taking care of that right now yes okay so if I can add a couple actually just one thing um I know you know the census is very important we just started we just opened up um for

people to do their census this month um so if we can have I know Ray came out and talked to us um now with this whole covert you know uh 19 and everything I would love to for to have him come out um some of us our attention maybe is not there I think it would be good to have them come out and do a presentation to us okay okay thank you anything further okay so I will read the items for clothes one more thing I'm sorry okay one more thing too and I got a little bit lost in what you were saying earlier to be put on the agenda to make sure we say them now or can I still email um you can always provide it in writing to either Dr Bauer or

myself or both and I can mention that right now and I mentioned that Dr Bauer already for a future item um I'll be bringing board policy 5420 um to look at again okay thank you okay anything else all right so the way closed session is happening everyone on the board and and the staff who need to be there have the link to the separate Zoom meeting where we will go um given a five minute break let's say between at the end of this meeting and and to the closed session we will have that and then um either Dr Bauer Mr Ruiz or Mr Gill can you refresh my memory on the report back of um the closed session are we we're still coming back or I think Mr Gill you were going to provide me

with access to this Zoom link correct correct Okay so do we have a rough time estimate Dr Bauer as to um for for a closed session one hour so um okay so I'll read these off we will go into closed session at 10 pm give or take a few a minute or two and we will return at 11 PM to this link where everyone is right now if you're in the zoom meeting will it also go to the yacht to the um YouTube channel um Mr Gill it's closed session sir no the report back I mean there's no report back for these items oh okay so then do we even need to come back to this link we just need to watch okay and the Board needs to uh take a vote to see if

you are willing all of you willing to be here till 11 because technically you're supposed to close at 10 30. okay so so there so just to be clear for the public the only reason we'll be coming back after closed session will be to adjourn there will be no report back from closed session so is there a motion amongst my colleagues to extend the meeting tonight a motion to extend the meaning to 11. second the motion is second to extend to 11. um all any public comment I don't think so if there is I guess we'll see it um but trust you so I'm sorry to interrupt but there is one item on the closed session agenda that is a claim for damages for which there may be an action and which may be reportable

so there may be actually one report out thank you okay thank you um okay so the motion on the floor to extend to 11 with the second um trustee Chavez do you approve do you yes okay trustee yes trustee Marquez and yes for myself unanimous passes so we will um return to this link for the zoom meeting at 11 PM if if there's an item to report back and if not to adjourn um so thank you everyone for your patience tonight you have to allow for public comment on any public comment on closed session items okay thank you let me read the items first and then um I'll ask for a couple of comments so if you have public comment on anything in closed session please send it now or prepare now item 9.01 announcement

and no not that one um okay 9.03 yes conference with legal counsel existing litigation um paragraph one of subdivision D I need to read everything Mr Ruiz no you don't you can just ask if there's any public comment on any of the items listed for closed session discussion thank you is there any public comment I see Mr Gill with his hand raise is that for a public comment yes uh there is one through an email somebody texted phone number ending with three five three one okay so it seems like Victor Vasquez so is it going to be read off or is he talking uh I assume I believe he wants to talk because he just mentioned the name public comment Victor Vasquez but he didn't describe anything there can we open up his mic I

see he's still here let me into that uh no comment to the board thank you okay thank you um okay so no public comment so with that we're good Mr Ruiz yes okay we will recess adjourn to um closed session and colleagues five minutes give or take as soon as possible take a bio break and I will see you at the other Link at 10 pm muslimentos thank you everyone be safe and we will hopefully see you next month just to remind everybody we're still on until Mr
