00115th board meeting. All five trustees are present. Um first order of business will be close session. We'll be talking about certain discipline, have a conference with labor negotiators, and discuss public employee discipline. And now we'll adjourn. Oh wait, adjourn to close session. Sorry, it's been a while. Good evening everyone. It's 7:13 p.m. and we are reconvening to open session. Um there are we did no actions during close session and I don't see any public comments on close session items. So um Vice President Qua would you like to lead us in the flag salute? >> Sure. Uh we stand please Thank you. And clerk Shiny Bassan, would you like to read the district mission statement? >> Yes. Uh, Bera Union School District provides all students the skills to become lifelong learners and successful 21st century global

002citizens. >> Thank you. And trustee Brewer, would you like to read the norms of the board of trustees? Y >> the Berasa Union School District Board of Trustees agree to focus on the best interest of students at all times. Be respectful, listen openly, address problems and process, not persons. Keep each other informed. Maintain confidentiality. Work toward the future. Learn from the past. Equal participation from all members. And stay on task. >> Thank you. And like I said earlier, there were no actions taken in close session. So now we will move to adopt the agenda. Is there a motion? >> I'll move to adopt the agenda. >> Second. >> All those in favor? >> I. Great. >> All right. So, let's move nothing on recognition ceremonial. I don't see any public comments on consent calendar. And

003we're on to the consent calendar. Can I have a motion? I'll move to approve the consent calendar. >> Second that. >> All those in favor? >> I. >> Right. No public comments on non-aggenda items. So now we're on letter 10A, quarterly report on Williams complaints. Thank you. And with that, I will pass it on to our assistant superintendent, Dr. Mccuri. Good evening. Um, no complaints were filed with any school in the district during the quarter January 1st through March 31st, 2026. >> Amazing. Great. And now we'll move on to 10B, measure U construction bond program update. >> Thank you. And we invite uh Dan Norris, our director of to share his monthly presentation. >> Good evening everybody. I am here like like Front said to do the measure U bond update for April. So here

004we go. Um the overview this hasn't changed so but I'll go through it. Project updates, school renovations, infrastructure improvements, technology updates, upgrades and safety and security enhancements. And in the program schedule, it's the phase one design and planning. Phase two is bidding and award. Phase three, construction and execution. And the last phase is completion and closeout. Right now, our project that are in design are uh school kitchen assessments. We're working with uh the director of food service to kind of finalize the um the schools kitchens um from first to last. So, I believe we're going to start with u the Sierramont kitchen first and then we're going to try to come up with a plan to do at least five over the next two summers. Um, so we're working with the designer design team and

005um trying to make sure everything's within budget and go from there. This summer we're u going to be moving the P1 and P2 portables over at Majestic Way. Um on the consent calendar, the uh ramps were approved. So that was the first phase in getting this um project underway. Um the I believe the actual contract for the portals will to the movement of the portables will go to the board I think next month. Um fire alarms at Siermont and Ruskin are going through GSA for approval right now. Uh exterior window replacement at Northwood. So, we've kind of figured out what materials and kind of approved renderings of what that looks like, window height, um what kind of materials. So, that's u going to be happening over the seven summer. Um library tables at all sites,

006that's ongoing. We're kind of getting a a number of um of tables needed at each site, whether it's a round table or a rectangle table. and the comprehensive infrastructure renewal and utility assessment. Uh that's the HVAC projects at Majestic Way in Somerdale. Those will be happening this summer. And just to remind you, those are boiler chiller system schools and we're replacing those with package units. And we've actually already started the process so we can get it done through summer and give our custodial team enough time to clean the sites before the start of next school year. All right, moving on to project out to bid. We have the Ruskin roof replacement for K1 and K2. Um, that project is out to bid and I'm sure that agreement will be uh in front of you um

007next month for approval. Um projects that did bid uh are the classroom opening reconfigurations um at Brookree, Majestic Way, and Somerdale. Those were on the consent calendar. those agreements and those were approved. Thank you very much. Um and as the storage shelving for all elementary portables, so we'll be um putting in two 5x6 portables or excuse me, shelving units as storage units in each of the elementary school portables and I believe that's later in the agenda for approval. Um, continuing on with projects in progress, uh, the B USD warehouse, we've made significant, um, um, strides forward with that project. Uh, right now the main line has been completed. That's the main water line as well as the site grading. And I have pictures at the end to show you of the grading, which is pretty

008pretty awesome looking. Um, Petemont asphalt, the mechanical area. I have that down as in progress. The actual was completed over the um last spring break, but since there's multiple parts to that um contract, that agreement, they're going to be doing the seal coating of the main parking lot in front of the school as well as replacing the complete and entire playground in the back. So, I didn't want to say that's a completed project since it's there's multiple parts. uh the Vincy Park door and window replacement which is happening this summer. Um that is getting down to the final decisions being made and the the everything else has been picked up picked out the materials used the the windows and all that stuff. Um and the TK playground structure at Brookree is in its second week

009and it's almost done. It's looking really good. Um, so it should be uh ready to go for use starting next week if we don't have any setbacks, which I don't foresee there being any. Um, and then we have the continuing on with the comprehensive infrastructure renewal and utility assessment, the solar part pieces. We're really close. Again, we're waiting on P Gen um to let us start making some power. Continuing with the projects in progress, the Sieront PA is almost completed. Actually, it is I think they started using it today. Um as well as this year um security. They kind of did that hand in hand. Um and then they'll start continuing down the line with the remaining um security replacements. Um also the Northwood fire alarm is in progress. projects completed. The landscape rehab at

010Somerdale, I think that was it was done for the 50th anniversary and it came out really great. I have some pretty awesome pictures um to show the board. Um the TK fencing at Somerdale came out really really nice. And then the exterior painting at um of portables at three schools. So I put this on there. We were supposed to get it all completed. We got two sites done. Majestic Way and Northwood. Um I'm excuse me. We got Ruskin and Northwood completed. Majestic Way. We could not because of the rain that we got over the last weekend, but it will be finishing up I think this weekend. And now on to the project uh program schedule key. Um so this is our wonderful color code key. And then the next three slides are basically what we

011talked about in a construction view. Um, and onto the pictures. So, here's the warehouse. When they started with the grading, they they removed a a lot of dirt um and um had it trucked out. There was about 10 trucks at a time, I think, picking up dirt um to get down to the the right elevation. So, those are the top two pictures. The bottom two pictures is a nice graded laser leveled um area and that's where our our slab will go for our foundation. And right now, so like the bottom left uh picture there with the the stakes, those are staking out the underground utilities that they're going to start digging for like the sewer lines and the more water lines and and all that. Here's Somerdale. uh the new uh landscaping up against the

012the perimeter of the whole building. We we did all the the wood chips and and added in a ton of nice five gallon size pot uh potted plants. Um we trimmed back the overgrown hedges. Um, again around the whole whole entire site as well as the front area. Um, as you can see up by the marquee sign and and at the street to give it that that curb appeal that we were looking for. And again, I don't know if you could see, but back in that corner behind the marquee sign is is where the new fence went in over the spring break for the TK playground. And there it is. There's the TK playground fencing at Summerdale. So, that came out really great. Um, and here's some the painting of the Ruskin portables. Painting of

013the Northwood portables. And that's it. Any questions? >> Any questions from the board? >> Sure. Why not? >> Let's start with the easy one first. All right. >> Uh the the summer frontage looks good. I saw it. It looks pretty good. The choice of plants. U what kind of plants did we put? Is it the native plants? I'm just curious. >> So I could give you the the scientific name. >> Okay. >> But I I'm not going to attempt it. >> No, I I honestly don't know the the actual name of the plant. I do know that we went for a a hearty plant that uh you know we didn't have to water every day. >> That's what my question was exactly. So okay that's >> and a plant that would last >> that that's

014the is it similar to what we have at what you did at Ruskin. >> Ruskin. Yes. Okay. >> So that's I think that's a good good one. >> And I believe uh Dan if you could share you have a listing from forestry that you work with in terms of what's native here and what's most receptive that you utilize. Correct. >> Yeah. Yeah. especially for trees mostly for that stuff. But we use our our city forest and they help us out with all that stuff. >> Yeah, that's good. That's um that's good. Um two more I think. I think I'll stop at two, but the first one is the um is with the HVAC uh system that we're replacing. >> Sure. >> Um so when you say it's the chiller boiler is being replaced with the

015u packs, right? Uh I'm just curious as to as to the technology that we're using for the for the for the packs. Are we trying to adapt to the uh you know what are they called? The heat pump type things or are they >> Yes. Exactly. Exactly. Heat pumps. Um they're fan coils with heat pumps. So we're eliminating natural gas. >> Yeah. >> And we put these on top of our roof. >> So we are completely energy efficient, you know, without gas. These are the latest techn technology carrier units. Top of the line, >> right? Okay. >> Yeah. But the is it correct? True that the upfront costs are slightly higher, but the operational costs >> correct. Correct. >> We save on the operational costs, >> right? Correct. >> Um, yes. And I could probably

016find out a little bit more information. And I don't know 100% those numbers, but um yeah, we're not paying for gas and we're >> at those sites anymore. And and >> a boiler >> those lines to feed a boiler are 34 inch. So that's a lot of gas. Um so I I would say yes. >> Okay. >> It is definitely cost effective >> combined with our solar panels with autogenerating and then using those that energy. So yeah, I mean I think that should be publicized more because they're at the same time they're we're achieving multiple goals to >> and I think the efficiency level of these new units are a lot higher. I think the old time was like 80% units and I think these are in the 90s. >> Yeah. Yeah. So I think

017uh I'm glad that we we are adapting to the newer technology that's out there so we you know so we don't have to repeat this exercise. >> Absolutely. Absolutely. things uh happen. Uh the other interesting thing was was with the Vincy Park door and window replacement. Now there was you know we know we're aware there was a issue with the with the HVAC system and and I got to understand that the the windows were replaced were were blackened out which caused which increased the temperature inside the rooms. >> Uh what are we doing with the window replacement? Are we >> doing that again or >> so I want to understand what what happened there and you know what is the >> Right. Right. So so the reason why we we painted the plexiglass windows is

018because they were getting marked up scratched and they just looked terrible. So, my idea was to put a layer of paint on to kind of match what Toyon looked like um and actually make the school look good again since we had just painted it. Um with that said, that area, that window is typically blocked on the inside by either curtains or furniture. So, I didn't think it was, you know, too bad of an idea to to paint them black. The new structure, right, will have a higher panel like a a Hardy backer panel, >> but the window above will be clear. >> I got >> So that will let a lot of the the natural light in. >> So you have a transom kind of a thing on the top or is it like a

019single unit or or is it like a window and the transom on the top? So, so the it's just a it's a a hardy backer panel to match the the remainder of the school and the window is smaller, but it's clear. >> So, it's above the door >> or above above the panel and it goes to the basically the bottom of the the ceiling. >> Oh, okay. I see. >> Yeah. Right. Okay. >> Yeah. And then I think the other piece to that um is also safety purposes, >> right? Unfortunately, that's another um another analysis piece for all schools now with window replacements. Um making sure that there cannot be direct view of who's inside the room. >> Yeah. Um so for for next board meeting, I will present a picture of a rendering of

020what Vincy will look like. >> Yeah, that that'll be that'll be great. And we're doing the same thing. The exterior window replacement on Northwood will be the same format. >> Yes, but the the the light the windows will be a little bit little bit larger. So, the panel will go up to about six feet >> and then the the window will go to the like I said the uh the bottom of the ceiling. >> Okay. >> Yeah, >> that's that's good. No, I think that's good. Thank you for clarifying and answering those questions. We appreciate it. >> Sure. >> I also had another question too. Thank you so much for your wonderful presentation as always. Always enjoyed looking at the photos. Um I was visiting Morell Middle recently and I know that we replaced the

021HVAC and everything, but folks let me know that they have um issues with ventilation and I was just curious about like if there's anything in the future that we're considering to help with like air purification. I know that folks are like, you know, there's no >> openings. I was just curious if we have anything on. >> So actually that project is still in process. >> Okay. and Dan can share that the ventilation flaps and things of that are currently being installed and re refitted. >> Yes. Yes. >> Not sure what the appropriate word terminology Dan can describe it better, but it's not fully completed. It's still in the process of having that being done. >> Yeah. So, to follow up with that, basically the economizers, the flaps were almost closed and so that wasn't allowing

022a lot of fresh air in. So, now we've opened those to 40%. Um, meanwhile, we're waiting for um and I believe it was approved on the consent calendar to go ahead and get those economizers um installed. And so that will really help the the the the fresh air as well as I had a team go through all of Morell over the break and make sure that all of the ducting was in place and all the baffles inside the ducting were actuating like they were supposed to. >> Amazing. Thank you so much. Any other questions? No. Okay. Thank you always. >> Thank you. All right. Next up is 11, superintendent report. Dr. Pentes, >> thank you. Um, just want to first of all welcome everyone back from spring break. I certainly hope all of our staff

023and families and students had a good time to have some rest and maybe some fun too during this past week. We have uh lots of really great things coming up that I wanted to be sure to highlight. And first I just wanted to highlight some awards and recognitions that are going to be um shared this month. Of course, we shared last month that Piedmont had been recognized for California Distinguished School. Uh we will be traveling with their school team at the end of next week down to Southern California so they can receive their um state award from the state superintendent of public instruction. So really looking forward to that. I also found out this week that one of our TK teachers at Brookree, Louisa Kamacho, is going to be recognized by Assembly Member Lee as

024our district area unsung hero. So really excited for her. That recognition is going to happen um on the same day as our Piedmont recognition. April 24th is just a really popular day for events. Um, and so that'll be in Fremont from 6:00 to 8:00 p.m. So hopefully, um, her Brook Tree colleagues will go out and celebrate her and everyone else that has availability. In addition, um, we have several, uh, administrators also being recognized this month. So, our statewide administrative association, AXA, is having their annual awards gala also on April 24th. very popular night and we've got two individuals in Beressa being recognized. Um Marita Mayora is going to be recognized as our rookie of the year um administrator and then Tom Carol is being recognized as our student services administrator for um Santa Clara County.

025So all of region 8. So really excited for them. In addition, uh we have lots of wonderful school celebrations coming up. So, as we've been talking about our facilities, we always reference our pod schools. Well, those pod schools are having their 50th anniversary celebrations this year. Just before spring break, Summerdale hosted their event. It was fabulous. Um the staff and PTA just did a wonderful job with snacks and and games and a silent auction plus their open house and everything was free for the entire neighborhood and anyone who came out. So it was really a great celebration and we have three more coming up. Uh so we have Vincy Park there next also on April 24th. Vincy Park is having their 50th um celebration from 5 to 7. They're going with the 70s theme, so

026make sure to dress up. And then uh Majestic Way and Brookree will also be celebrating their 50th anniversary um celebrations on May 1st. Majestic Way from 3 to 6 and Brookree from 5:30 to 8. So um I just want to let our community know this is open to everyone. We love to have alumni come back and visit their school sites. There's always um yearbooks that go way back. You can see fun pictures, um you know, the the school spirit t-shirts from all the decades and just a lot of fun. So, we really encourage everyone to join in those celebrations. In addition, uh you know that we have a wonderful music program in Beressa and we've been able to expand um music instruction and art instruction for our students with our Prop 28 dollars. And so,

027uh we have an upcoming uh district-wide concerts that are going to be held at Merill's BYC. So, those are going to be next week. We have the all district band concert on the 21st from uh at 6 pm and then the very next day on Wednesday will be the orchestra district-wide orchestra concert um at 6 pm. So again open communitywide. Our students are so talented. Our teachers do a fabulous job um with them and so it's a great evening just to hear those performances. So, wanted to make sure to give a shout out for that. And then we're also in openhouse season. So, we've already had Somerdale kick that off, but we have several others coming up uh this month as well as in May. We have one tomorrow, which is Ruskin. Ruskin is tomorrow

028from 5:30 to 6:30. Majestic Way and Northwood will be on April 23rd. and then Brookree Noble and Vincy Park on May 14th. So again, it's a good opportunity to see this the progress our students have made through the course of the year. Teachers always share great projects that they've been working on. You get to see um you know, all of their good learning. Uh but again, I also invite all our parents. It's also an opportunity to get a sneak peek at the next year that your child's going to be going into, you know, for school. It's a good chance to meet that potential teacher and see the kind of work they're doing in that next grade up. It's also enrollment time. So, this is also a good opportunity for families to come on to our

029school sites to see the great school cultures that we have and all of the good teaching and learning that's happening. So, just want to make sure that we highlight those events. And um then also we have another big event that's coming up at the start of May, but I want to make sure I acknowledge it here because when our next board meeting happens, the event would have passed. And that's our Beressa Art Festival. There's a wonderful committee of volunteers that have been working for months along with our support staff. I know Dan out there is part of a key member of that planning committee as well as some other folks in our district. Um so it's Saturday, May 9th, uh from 10 to 5. Uh you can park over at the Beressa Community Center and

030join the fun. Our students will be performing. There'll be lots of other community groups performing and all of the proceeds raised go into um scholarship donations for our teachers that they can apply for special projects for their classroom. So, just want to encourage everyone to join us on that Saturday. And then finally, um, we know that there's a lot of movement right now with the state budget and a lot of advocacy. And so next week I will be in Sacramento lobbying on behalf of public schools to ensure that we get the Prop 98 funds that are due to us. There's 5.6 billion that's being withheld for Beressa. That calculates to about 4.9 million. So that amount of money could be a significant support to our students in our classrooms. And this is really a prime

031opportunity for everyone to advocate the importance of those dollars. And we encourage everyone to call or send letters to our elected officials letting them know how important that funding is for us. Thank you. >> Thank you so much for that wonderful report. And do we have any comments or announcements from the board? No. All right. Um, nothing in review and discussion. So, we're going to move on to 14A, a public hearing for disclosure of the California School Employees Association on their collective bargaining agreement. So, I'll call this public hearing to order. No comments, I don't think. So, I will close the public hearing. And next I will move on to a public hearing for the disclosure of the teamsters collective bargaining agreement. I will open that public hearing. Seeing no comments I will close it.

032All right. So next up is 15A. Um we have a CSBA region 20 delegate assembly runoff election. It is recommended the board select one representative for the California School Board Association Delegate Assembly for Region 20, Santa Clara County. In this runoff, you have two candidate choices. Elizabeth Holidayiday from Campbell Union High School District or Jod Mirhead from Santa Clara Unified. >> Thank you. So, I'm looking to the board if they have any preference for one of the candidates listed. seems to be looking at me. >> Um, yes, >> you can press your >> We have two. >> Sorry, we have two candidates here. That's Elizabeth from Campbell Union and Jod. As I mentioned before, I have known Jod for a number of years and um and she is the incumbent. And I received something today

033from Elizabeth and that was for us to to reconsider her as a as a candidate and um and to elect her. and she seemed to be very very um she's such a strong advocate for school funding and she wants to once once she gets elected, this is what she told me and I'm just um relaying the message to all of my board members here that she wants to really be open to us and to always communicate with us. and her her um strong advocate as I mentioned is truly the school funding which the superintendent is going to Sacramento to advocate for all of us. So for me personally even though I have known Jod for a for many years and she has been on it for quite a number of years I would like to

034see if Elizabeth Holidayiday would be a good a good uh candidate for us. and it's up to you. >> Interesting. >> So, I move if that's a possibility. >> That's a good perspective. I did see that email also and I appreciate her passion. I know Jodi also uh through our SECSBA meetings. Um, I I I I've seen her, you know, work uh hard and, you know, advocate for all of us all of our um schools in the county. Um, but that's an interesting uh persp about about these things. So, um yeah, I mean if if uh if if you're confident that you know that uh Miss Holiday will be able to follow through on her uh commitment, then I I I don't have any problem with uh uh with seconding that motion. It depends on

035the rest of my colleagues. >> Yeah, I'm surprised too. But I but I am also open to it too because I also know Jody. I know Jod's done a really great job, but um yeah, I'm just curious. I because I did not receive the email from Elizabeth. Like what what is her experience? Like do do we know other details about um Elizabeth? Just because I know Jod like I know that she's been a strong advocate. So I'm just curious about like other thoughts too about how she's worked or done before because I I just personally haven't met her. So I'm just asking. >> Yeah. I mean she's she is part of SCCSB also. I see her as well >> whenever I'm there when she she has um >> so I mean like like I said

036the the u we know that you know for sure Judy has been a great blessing at all. see any issues with it. But but with respect to the commitment to uh fighting for us on behalf of us for >> for state funding and making sure you know that commitment and she's so passionate about it is why >> I was I was thinking but uh you know I I'm okay with either one there. I you know I've seen Jod work. I've I've heard Elizabeth talk. I agree that I'm not interacted that much with her. Um but uh but yeah, whatever the majority thinks, it's fine. >> I don't think we can go wrong with either of the two candidates. >> Yeah, I think they're both Yeah. Okay. Yeah. Any other thoughts from anyone else? >> I

037agree. I I support either candidate. They're they're both good advocates. >> Um I really trust the wisdom on the sport since I'm new and I'm still getting to know folks. But you were asking about her background. So, I I pulled up her email just cuz if all of us did not receive it, I thought it might be helpful. Oh, >> great. >> Um, she says she's um co-chairing a leading in challenging times workshop this past January. Um, she served on the Hoffman awards committee for the past two years. She recently joined a success committee. Um, she's also leading a team of trustees through the systems thinking leadership course with the California academic partnership program. and she's the incoming uh SEC SBA treasurer. >> So, there's just some data points, but I do definitely lean on

038you all. Um, and it sounds like we have two excellent >> options. Um, and I do, you know, being new in my in my seat, I I'm biased to people who are passionate and want to do something. So, >> um, I will follow your lead. Okay. on a personal level. Uh Jod and I are are on a committee together. I have to see her next month. Just wanted to put that out there. But and she knows that we're meeting tonight. So I told her that we're our meeting is tonight. But uh but I mean like like I said you know uh in all seriousness I think uh both are very passionate leaders and you know they they bring their own strengths and uh Jod is very seasoned um and and that's before sitting down that

039was one of the I was leaning towards Jod because she's very seasoned. she knows how to get the answers and things like that. But uh Miss Boak's perspective changed that a little bit for me. But but uh yeah, like how you lean on us, I do lean on Miss Buack's wisdom on on that. Um but yeah, I mean what's the consensus? I mean, I think it's okay with me. >> Yeah. >> Okay. >> Yeah. Okay. We have a motion and a second. So any all in favor? I >> I >> Any opposed? >> I >> Okay, great. Sounds good. I love how we're always so consensus building. That was Elizabeth. >> Well, we have a passionate one, so I'm supportive. >> Great. All right. Next up is resolution in support of childcare for all. And

040>> yes, it is recommended the board adopt resolution 2520 in support of child care for all. and President Hog, I leave it to you to add some additional highlights to this resolution. >> Yeah, of course. Thank you so much. I wanted to bring this resolution forward because we have Kadango opening at our toy on site and I wanted to share with you all a little bit about um what I advocate for al partially my day job because I actually co-wrote this resolution with um Chris Norwood. This is a resolution used as a tool to educate schoolboard members about the importance of supporting um child care in your community. Um you know as you know we have declining enrollment and it mainly is due to in part of the affordability crisis that we have here in

041San Jose and one of the solutions to that is providing affordable child care or child care for our growing families so that they're able to stay in our neighborhoods and be able to go to our schools eventually. And so in the resolution, I just have a lot of points about um what different types of things that we could look into, mainly celebrating Kadango coming into our school district and also joining Build the Future. And Build the Future is a nonprofit movement. Um they've passed resolutions um in all of the cities except for one in Santa Clair County. They're moving to pass resolutions in all the school boards really as a tool to be able to let school board members know that um child care is incredibly important to not only our economy but for our

042schools and it's really something that um we should continue to support you know especially as Kandango is growing. We would love to continue to see their expansion their growth and other providers too to come into Beressa to really help our young families be able to stay in our neighborhood so that they can one day come to our school. So that is why I propose this resolution. >> Motion. >> Yeah, >> it's very good. Thank you for that resolution, President Hog. U I'll move to adopt resolution 2520. >> I'll second that. >> Thank you. And it's our resolution. So it's a roll call vote. Yes. President H. >> I. >> Trusty Nuin. >> Hi. >> Trustee Shivasan. >> Hi. >> Trustee Brewer. I trusty Boak. >> I thank you. And the resolution passes. All right. Next

043up is board bylaw 9250. And I'm just going to share with the board um A3 4 and five all go together. We have the policy as well as the related um exhibits. And this is for board bylaw 9250 uh remuneration, reimbursement and other benefits. And it is recommended that the board review and approve this bylaw and related exhibits. Um as stated for first reading, this is just bringing uh the language up to code. There was new law that was passed last year, late last year, uh regarding um compensation scale for trustees. They also cleared up the language um emphasizing that any uh compensation or benefits that trustees can access, it's at your discretion. You can also decline. So that's also language that's been placed in here as well as um the procedures that need to

044take place when you do receive contribution and um you are absent to a meeting and pro-rated practices to do so. >> All right. Since these are all related, we can entertain a motion for all three as well. >> All right. I'll move to adopt. How do I do this? >> Second. >> Hang on. I'm not done. >> Oh, you're not done. Okay. >> The board bylaw 9250. Um and uh move to review and approve board exhibit E1 9250 and uh board exhibit E2 um 9250. >> Okay, there's a motion and a second. All those in favor? I I any oppose? Seeing none, all three pass. >> Next up is board bylaw 9323. Thank you. It is recommended the board review and approve board bylaw 9323 meeting conduct for a first reading. And what this um

045bylaw does is it um clarifies that the governing board meeting is chaired by the board president and then if the board president is absent then we will define another trustee that will take on the chair position. But also um what it adds is clarification regarding disruptions at board meetings. So in the event there were there was something disruptive occurring during our board meeting, the board chair has the ability to have that individual or individuals removed from the meeting so that way business can continue to be conducted. What the new language clarifies is that the board cannot reconvene in a separate location because there's disruption happening in the public meeting space. You're not able to do that, but you are able to clear the room, make a recess, and then come back and reconvene in the

046same public space for your public meeting. >> Thank you. Is there a motion? Question. >> I'll second that. >> All those in favor? I. >> Any opposed? Seeing none, that passes. All right. Next up is item B1. CSEA collecting bargaining collective bargaining agreement. >> It is recommended the board accept the certified disclosure of the California School Employees Association chapter 364 CSCA collective bargaining agreement from the Santa Clara County Office of Education. >> Move. Go ahead. >> I'll move to accept the certified disclosure for CSEA. I'll second that. >> All those in favor? >> I. Great. Next up is B2, Teamsters Collective Bargaining Agreement. It is recommended the board accept the certified disclosure of the Teamsters Local 150 collective bargaining agreement from the Santa Clara County Office of Education. >> Move to accept the certified disclosure

047of of Team Service Local 150. >> I'll second that. All those in favor? I I >> Great. Right. Next is B3. Um resolution uni unanimous written consent. It is recommended the board adopt resolution unanimous written consent and approve the SBA first amendment to the communication site lease agreement to include six additional successive renewal terms of 5 years. And this is a an existing lease agreement um in our district that's expanding their term. >> Questions or a motion? >> Move to adopt resolution 25-17. >> I'll second that. >> All right. This is a roll call vote for resolution. >> President H. I. >> Trusty Nuin. >> I. >> Trustee Shinasa. Hi. >> Trusty Brewer. I >> Trusty Boak. Hi. >> All right. And the resolution passes. Next up is board policy 3515. It is recommended the

048board review and approve board policy 3515 campus security for a first reading. Um this updates uh our existing policy based on um the Department of Homeland Security has created a new behavioral threat assessment and management in practice guide that now has to be referenced um in this policy. >> Any questions or a motion? >> I'll move to approve. >> Go ahead. I'll second that motion by Trusty Boat. >> Great. All those in favor? I >> I >> Okay, great. And next up is board policy Oh, I'm sorry. We should have bashed them. 3516.5. It is recommended the board review and approve board policy 3516.5 emergency schedules for first reading. So, this policy is related to any time that we have to close school for emergency purposes. So new language is being added to include health

049conditions as part of those emergency considerations. Usually it's fire, natural, you know, earthquake, power, those kinds of things. Health condition is also being added. In addition to that, um there was language uh that post July 1, 2026, when these emergency closures do occur, our school district is still obligated to ensure continuity of learning for our students. Um and that can happen in a variety of ways whether it's you know independent study uh uh virtual learning you know we have discretion in that but we have to have a plan to ensure that students aren't impacted with any learning loss. >> Will this be applied uniformly? >> Yes. >> The expectation is it applied uniformly throughout the district or the affected site? Uh well, a lot depends on the occurrence, right? Sometimes occurrences are sight specific versus

050a district-wide occurrence, but we would have a uniform plan for any site. >> The reason I'm asking is I mean if you say virtual learning, the kids get to stay home and parents are there. So, so I'm just curious, you know, whether other sites will say, okay, we want to also want virtual learning. um want to stay home uh and learn online. Is it is it necessary for for it to be implemented districtwide? >> No, that's not correct. >> It's not mandated like that, right? It's correct. Based on um the need >> Sure. >> of the site. >> Yes. And very similar to how we pivoted during COVID. Um but this actually this new language is a result of COVID and the pandemic. And um because if you remember during that time many of us

051did not have plans and we used those first few weeks to determine what that next step was going to be. Now that we've had that experience now it's in legislation that we will you know ensure from that day that there's continuity of learning but we do have flexibility on what that learning looks like and it can adjust. It can start in an independent study manner and then evolve into a virtual studying so long as the students are getting their instruction. >> Yeah. >> Interesting. Okay. Good. Good to know. >> All right. I'll move to review and approve board policy 3516.5. >> I'll second that. >> All those in favor? >> I. >> Great. Next up, item C1. Dr. >> Thank you. Uh for this item, just to make a note, um we do have a

052revision to the attached salary schedule. There was a uh two errors that were caught. So we do have a replacement schedule that has been provided here for our public and will be attached in our minutes. Um but we do recommend uh that the board approve the contract language changes. Um and the teamsters a this one ten in the I'm sorry, the tenative agreements with uh California School Employees Association chapter 364. Um I also I I know we've had our public hearing and you've had other um action items in regards to this uh tenative agreement and I just want to thank um our CSEA partners in working with us and reaching this agreement for their members. Thank you so much. Any questions or a motion? >> So move to approve the recommended contract language with the

053with the revised salary schedule as published. >> I'll second. >> All right. All those in favor? >> I. >> Thank you so much. Next up is C2 for teams. It is recommended the board approve the contract language changes in the tenative agreements with Teamsters Local 150. And again, I'd like to reiterate our um gratitude and thanks to their leadership and their negotiating team for working with with the district uh to collaborate on this agreement that you have before you. >> Any questions or a motion? Move to approve the contract language changes in the tentative agreement teams as local 150. >> I'll second it. >> All those in favor? >> I. >> Thank you. Next is C3, resolution 2518. >> It is recommended the board adopt resolution 2518 to issue final layoff notice to the affected

054classified employees for the 2627 school year. I'll move to adopt resolution 25-18 to issue the final layoff notices. >> I'll second that. >> Okay. And this is a resolution. So we have a roll call vote. >> President H. >> I. >> Trusty Nuin. >> I. >> Trustee. >> I. >> Trusty Brewer. >> I. Trusty Boak. >> I. >> Thank you. And the resolution passes. Next up is resolution 2519. >> It is recommended that the board adopt resolution 2519 to provide affected employees notice of termination or reduction in assignment for the 2627 school year. >> I'll move to adopt resolution 25-9 to assign the non-remployment notices. >> Let's second that. Okay. >> And roll call vote again. President Hal I. Trusty Nuin >> I. >> Trusty Shernasan. >> Hi. >> Trusty Brewer. >> I. >> Trusty

055Boak. >> I. >> Thank you. And the resolution passes. >> All right. Next is D1 board policy 5000. It is recommended the board review and approve board policy 5000 concepts and roles for a first reading. This is uh an umbrella policy piece that just describes um the overall purpose of every policy that's in the 5000s which impacts our students. Okay. >> Move to review and approve board policy 5000. >> Second. All those in favor? I. >> The board policy passes. Next is D2, board policy 5117. It is recommended the board review and approve board policy 5117 interd district attendance for a first reading. Um this is just uh there's an updated component to the interdist attendance policy in California. There's been an option for districts to um function as a schoolof choice district. that option

056was going to be sunsetted last year, but then a uh legislation was passed that extended that option indefinitely. We don't operate that program here in Beressa, but it is an option if the district wanted to consider that in the future. >> Right. Move to review and approve board policy 5117. >> Second. All those in favor? >> I. >> All right. And last, board policy 5131.8. It is recommended the board review and approve board policy 5131.8, mobile communication devices for first reading. This is the policy related to last month's middle school uh cell phone presentation that you all received. And so this is the one that'll bring us up to date based on the law requirement for July 1, 2026. And we still waiting for um implementation for elementary schools, correct? For next, is there next

057schedule for next school year? >> They all go together at the same time. >> I see. Yeah. >> Yeah. >> Do they currently have a policy? Because I I did see a few students using the cell phone in the elementary schools, which is why I'm asking whether what is their current policy. >> So there is no current policy right now. So this will be implemented elementary schools as well. >> After this, they have to do. >> Yes. Okay. Gotcha. So, let's hurry up and do it. So, move to review and approve board policy 5131.8. >> I'll second that. >> All those in favor? >> I. >> All right. Next up is our bond program E1. It is recommended the board approve the AMSNET LLC DBA management impact solutions agreement for the uninterruptible power supplies through

058the -ate program for all district sites. >> Yeah, this is needed for sure. So move to approve the um the agreement. >> Second. >> All those in favor? >> I. And now we're on to E2. It is recommended the board approve the use of the Sierra School Equipment, Inc. request to use the Arvin Union School District piggyback contract 2023 24012 for the purchase of storage shelving and installation at the classroom portables at elementary sites. >> Awesome. We need that, too. Any questions or motions? I'll move to approve the um the piggyback contract for the purchase of storage storage shelving. >> I'll second that. All those in favor? >> I All right. Are there any quest requests for staff followup? >> Almost done. >> No items for future agenda. No. All right. And our meeting is

059adjourned at 8:08 p.m. on the dot. Thank you.
