I would like to welcome everyone especially this is the first board meeting for this 2025 2026 school year. >> Right. Let's uh begin with the flag salute. Trustee Jimenez, could you please >> everybody stand face the flag? >> Hand over your heart. Ready? Begin. I pledge allegiance to the flag to the flag of the United States of America and to the republic for which it stands. One nation under God, indivisible, with
liberty and justice for all. >> Thank you, Trusty Himenez, for the district mission statement. Trusting Ouyen, could you please read our district mission statement? >> Yes. The Beressa Union School District provides all students the skills to become lifelong learners and successful 21st century global citizens. >> Thank you Trustee Goen for the norms of board of trustees. Trustee Shinasan could you please read the following? >> Uh surely uh the Birasian school district board of trustees agree to focus on the best interest of students at all times. Be respectful, listen openly, address problems and process not persons. Keep each other informed, maintain confidentiality, work toward the future, learn from the past, equal participation from all members, and stay on task. >> Thank you, Trusty Shane Basan. The disclosure of action taken in close session. I would like
to read this now. Agenda item 2.8, H public employee performance evaluation government code section 54957. Uh, six public comments and consent calendar agenda items. There's none. So, could I please have a motion to approve the consent calendar? >> Move to approve consent. >> I'll second it. >> It's been moved and seconded. All in favor say I. >> Opposed. Motion is carried. Let's continue on to 78 consent calendar. Where is that now? All right. Item number eight, comments from the
public on non-aggenda items. Oh, we do have a speaker. All right. Before I call on the speaker, I would like to read the speaker conduct. Any such adjustment shall be done equitably so as to allow diversity of viewpoints. The president may also ask members of the public with the same viewpoint to select
a few individuals to address the board on behalf of what viewpoint uh board bylaw 9323. Speakers are reminded to communicate with respect, fairness, and courtousness to each other and to all present. We ask that you not use the name of any district employee in your comments. The board welcomes orderly communication from the public. Thank you. I would like to call now on um I think it's Janet Y or is it Janet Yu? I'm sorry. >> Is it you or ye? >> Hi, it's Janet Yu. >> Janet U. Okay. I'm a parent at Ruskin. Um hopefully I have a quick question. Um as y'all know, first day of school, it kind of got wild over there, especially with traffic. Um, I know that Ruskin is designed to have like 700 students. However, that was from way
back when when most people lived in the school boundaries and now there's so many people driving in. It was kind of a mess. I was wondering if there's any um anything that's going to go in place to try to like get um what is it the traffic safety out there kind of like how they have in front of Pemont Middle School um from the city of San Jose or anything like that. That was all my question was about was to see if there's if anybody knows if they're going to try to bring in um just actual official safety to make sure that those crosswalks right there right by where Pimont Hills High School is going on to Ruskin on Crater and the one between Siermont and Ruskin can have some type of safety patrol there.
Thank you. >> Thank you miss you for your comments. We shall continue. Item number nine is reports on presentation. A quarterly report on Williams complaints. Uh madame superintendent, please. >> Yes. For this I will defer to our assistant superintendent of ed services, Dr. Joe Mccur. >> Sure. No complaints were filed with any school or the district during the quarter indicated above April 1st through June 30th, 2025. >> Thank you, Dr. Mareri. B, measure U, construction bond program update. Uh, Madam Superintendent, please. >> Yes. I'd like to invite uh Tony Kistab, our bond program director to share the monthly report. >> Hello everyone. Um, the first picture is actually the Piedmont Middle School. It's the new windows on the NPR. And again, I'll just update on the projects and then the schedule. Um, first things, the
things we've completed are again the windows at Piedmont. Um, the fire alarm at Vincy Park, the PA system at Somerdale. We did additional storage um at the pods at the sister schools which are Brookree, Majestic Way, and Somerdale. um part of the comprehensive infrastructure renewal program. We actually completed the central kitchen. And when I say completed, it's actually connected to the solar is actually connected with PG& um and I'll I'll talk about a few more things that we actually have done, but we're still waiting on the interconnection. Um exterior siding at Vincy Park that was completed along with the painting. The one thing I didn't list on here that I forgot about was the at Majestic Way at BPOD, we actually did some classroom configuration and that was completed. So, we did that at one
as a test that was completed. So, we're going to um talk to the teachers, see how it works out, and then hopefully next summer do it at all the sister schools. Um again, we're going to bid out the um warehouse building tomorrow. We'll see how what that comes in at. Um Oops. again. Then we have HVAC at the old district office. That'll be completing this week. Um replacement for Majestic Way and Vincy Park. They're working on Majestic Way right now and then as soon as they're done there, we'll go to Vincy Park. Um again, the comprehensive infrastructure renewal program. The mechanical systems, Brookry was basically 98% complete. We actually occupied today with the new mechanical system. They still have to do punch lists and things like that. So they're technically not complete, but we're in
the building. Everything's working pretty well. Um, again, the solar, so at the district office, Morell, Piedmont, and Sierramont, it's all been completed. We're just waiting for PG& to connect to their system so that we can actually start generating power. And then Lane View and Cherrywood, they actually start next week. And I did skip to they're working on that right now. and that's supposed to be completed in the middle of September with all the mechanical work. Um things that are in design, we have um the Vincy Park modernization that's actually complete. We're going to bid that this fall for work during the summer of next year. Um then we have the pavement at Piedmont, their playground again. We'll bid that this summer or I'm sorry, bid that this fall. We'll do the work next summer. school
assessments. We'll start working on all the kitchen assessments and start designing that for hopefully some work next summer. Um the fire alarm at Northwood that's actually ready to bid again. We'll bid that and they'll start working on that probably in October. And then security alarm replacement we'll start bidding those things out and hoping to have all those the rest of the schools completed by the end of August next year. And then the PA systems. Again, we hope to have all those completed by February of next year. And then I have a few pictures. This again is the new exterior walls at Vincy Park. It doesn't look all that great, but honestly, it looks when you're there, it's hundred times better. The biggest thing is there's no holes. Um again, this is just one of the
solar projects at um Sierat. Um again, Sierat. Oops. It's not the Majestic Way MPR wall. Um, this is the storage units that we view that we put in this summer. Um, and we'll get some feedback from some of the teachers, but so far I think it's been pretty good to be honest. I was surprised when they said the FOS boxes actually fit right in the in the slots. I'm like, and of course, we measured them everything to fit those boxes. Um, and then again, this is just the schedule to complete everything else. Um, any other questions? >> Any questions from the board? >> Go ahead. >> Quick question. Thank you for the presentation. U Tony, the sighting and this you might have brought this up uh before so I apologize if it's uh it's I'm
bringing it up again. Uh the sighting looks good on Vincy Park. Uh I had brought up um issue with Northwood when I was on site. There were some parts of the sighting or or the uh classroom that were that had uh you know like gaps or holes or whatever that is due to age you know. >> Was that was that ever addressed or was there is there a plan to replace that too? >> So that was never a bond project but we can actually take a look at that and create a project more right. It was more of a maintenance thing. I see. >> So again if if it's big enough we could actually look at that as being a bond project but we'd have to actually create one for that. >> Gotcha. Okay. Thank
you. >> Any more comments? >> Thank you very much. >> You're welcome. >> We shall continue. Um item number 10 is superintendent report. Dr. Fuentes, please. >> Yes. Thank you. Um uh first and foremost, I just want to thank everyone across the district and all of their diligent effort to make today a positive first day of school for our students. Um, I was out at five different sites today and everyone was doing their best to to be acclimated, to welcome the students. It's great to see the children once they saw a former friend, you know, they were all smiles and hugs and ready to start their first day of school. And I know it's a a heavy lift, especially this year with all of the transitions for our staff and finding themselves in new spaces
with their families and the students. So, I just want to applaud uh their efforts and and all the care, you know, our teachers and support staff give to to the students to make sure they have a great first day and a great year this school year. So, thank you to everybody for that. Um I do want to respond to some of the safety questions because yes, we have been working with the city of San Jose. Uh Ruskin is actually um one of is the first school location that they will be doing traffic study. Um the traffic study will take place the week of September 23rd. And so um what we were told by the city was that they wanted our schools to be in session uh for a few weeks. So that way um the
amount of traffic balances out in terms of whatever that's going to look like for them. So, and when they do the study, they will take into account all possible measures for any revenue, whether that means um anywhere from an additional crossuard support or um uh adding a crosswalk or doing the additional fixtures to crosswalks like lights, stop signs, those types of things. um they will take a look at that because we've expressed from the beginning with them last year as soon as the board um made the decision on the sites um of what that capacity would look like and knowing already the existing traffic congestion that happens between the high school, the middle school, the elementary site um you know what that increased uh traffic might be. So we also for this week I'm not
sure that they were out there because there was a lot of folks. We did request parking enforcement support and uh we put in uh several requests uh with the agency. Um welcome our parents to help us do that too because we we did request that especially um as new families are finding their way to their schools and trying to figure out what's the best way to get there. And of course um you know encouraging our families uh that can you know to walk to school to try to alleviate some congestion. We're a walk-in roll district. That's a partnership we've we've had um for years. Uh but definitely we know that there's some city participation in this uh to be able to re-evaluate um different safety measures that we can put in place with their support.
>> Thank you, Dr. Fuentes. >> Quick followup question and it's for all sides. I mean, Ruskin being our largest site, it's >> very visible. Uh are there is there any protocol for approval? I mean for example if a parent wants to if a group of parents want to step up and you know help with traffic or you know manage >> uh help with kids crossing >> is there any protocol for us to the board to approve it or the site principal to approve it? >> It's the same as our volunteer process. So we have our volunteer process through human resources. Uh we've also encouraged our principles in their newsletters to communicate to families that would like to volunteer and and be supports in the meantime. And we do have um other sites that are scheduled
for traffic study. It includes Ruskin, Northwood, Majestic Way, Brookree, Vincy Park, and Somerdale that they're all on the list with the city. >> Yeah. Perfect. Thank you. >> Yes. Thank you very much. We shall continue. Uh item number 11 is the comments and announcements from the board. Do we have any announcements from the board? Uh Trustee Jimenez, >> guess it's time. So uh uh I'd like to announce to the community this is my last meeting as a board member. At the end of this month, I will be leaving my seat as a board member. Um and it's nothing negative. It's, you know, it's a little bittersweet for me. Um so the reason for that is because I will be pursuing a law degree. Um so you know I'm looking at our mission statement um you
know it says Union School District provides all students the skills to become lifelong learners and successful 21st century global citizens. So that you know that term lifelong learners it applies to everybody not just our students it also applies to board members. Uh so uh you know it's something I I've always wanted to do. Um and you know life sometimes takes you places and you have to pivot or you know make decisions uh based on what's best for you. Um so that being said yeah I will be pursuing a law degree and yeah that won't leave any time for pretty much anything else. So unfortunately that includes you know my uh service as a board member. Um, but I'm very proud of um I think you know of the legacy that I leave leave here. And
I'm uh I wouldn't do this if if I wasn't sure that the district is in good hands uh with the rest of my fellow board members uh and with the with the staff, with the cabinet, the superintendent, um all the principles, teachers, uh really I mean just u top top-notch uh you know educators all across the board and I'm really proud of the work everybody here does. Um, so and I know that the district is going to continue on a good path and I, you know, I leave this district and and I'm, you know, I'm extremely confident and that will continue being a terrific district and al, you know, of course I'll still be part of the community. If something, you know, goes arai, you will hear from me. So, and I'll have new arguing
skills. So, you know, you might want to be careful. Anyway, um, yeah, you know, it's just so many things that happened over the last uh, 11 years. And I'd like to thank, you know, the community, uh, you know, first and foremost for putting this trust in me. Uh, it's it's a responsibility that I took very seriously and and I hope that I, you know, represented everybody well. I I certainly did my best. Um so you know through tough choices through you know successes we had as a school board and as a district um you know passing school bonds um you know uh having uh balanced budgets uh you know uh great relationships with with our labor partners um you know just a lot of uh great things that we've done in this district. So thank
you all and um you know I I wish the district continued success because I have three you know two kids still in the schools. So thank you very much. Thank you, Trustee Himenez. Anybody else? Go ahead. Trusty Shinabasan. >> So, in light of uh in light of this new revelation that uh you're uh this will be a last board meeting, I want to appreciate uh all your hard work. You've served us served the the school district with diligence. Um over the past 11 years, has it been? Oh my god, time flies. >> A long time. But uh you know when I when I first started I I I said you know it's an honor for me to uh serve alongside stalwarts of the community. you have always said that and uh you're one of the
stars of the community and I really appreciate uh your voice um your voice sometimes is painful when you're sitting in the president's chair but but uh you need that kind of uh voice to bring you down to uh to earth and you're and you're not sure about what you're uh what you're doing or what you're saying. You need that level-headed voice, a loud voice to uh to bring you back uh to to knock some sense into you, if you will. And I think pursuing u a law degree is perfect. I think for someone like you and you know for sure uh I appreciate it. I appreciate a council. you know, I think I've uh spoken to you multiple times over several things and you're one of the first I think the first board member that
congratulated me after my election win and I always have fond memories of that. But no, no, I appreciate u you know your friendship and your council over the years and you know that has just u taught me uh how to govern uh be an effective board member and and I really appreciate the time. Thank you. >> Thank you Trust Shinasan. Interestingly, I also want to thank you, Hugo, uh for the past uh 11 years that you've served uh with us on the district uh board. Um it's been a pleasure working with you. I know all the the decisions and guidance that you've given the district has always um been uh very thoughtful and you know, you always put you know, feelings aside. Everything has always been objective, always been in the benefit of the district
and the community. So, I thank you for that. And again, it's been a pleasure working with you and uh you know, I hope to continue to see you out there in the community and um and I hope to see you do great things. uh once you accomplish your law degree. >> Thank you, Trusty Goen. I guess it's my turn. Um I've known Hugo since he was in high school. He was actually a freshman when I was teaching there and I still remembered him putting his binder underneath his arm and he would be walking briskly. Um and then um when I became a one of the villa principles of independence, of course he grew up and um I think he was a senior or might have been a junior, I can't remember anymore. And I would
be patrolling the um the uh the school grounds and he would he would be there with his girlfriend and I would always I would always tell him, "Excuse me, but the bell has rung. It's time for you to go to class. And by the way, that beautiful girlfriend is here. His wife, it's uh Melissa. And anyway, I don't know if Melissa remembered me, but I used to do that on a daily basis with Hugo. But um all these things I have a deep connection with him because of my relationship with him when he was just a teenager. But I really will miss him and I um I want to thank him for his exemplary service to our school to our students actually and to our students and to the community and uh to our school
district. So, yes, I'm rather emotional because I have I've known him ever since. And so, I I felt like he was my son and um I think my son was going at the same time he was going when I was teaching there. But anyway, thank you so much for everything you've done for our district and for our community, Hugo. And I'll be calling you um for some advice as well, especially with labor and all that stuff, okay? because you're such an expert in labor. So anyway, thank you so much. >> Thank you. >> I'm going to miss you. >> And I know you'll become an a great lawyer. >> I hope so. >> I think so. Um anybody else? >> Just uh one one final thing here. We just have a certificate of appreciation for
you to commemorate your 11 years of service and certainly a big thank you to your family for sharing him with us for these past 11 years and all of our board meetings and different uh conference attendance that we've had to go to and be a part of and all the late night phone calls and planning. Appreciate all of that time and dedication. We also have um cake and punch to celebrate your time with us. So once the board president's ready, we can take a brief recess to have that celebration. >> No problem. I think right now we can take uh how many 15 minute break so everyone can enjoy what's in the back right now. And uh of course and also the kids here. Hugo's children are here. I'm sure they would love the cake
and drinks and everything. Thank you. 15 minute break. Thank you everyone. >> Thank you. Thank you for your service. Yes. >> Thank you for everything. >> I'll still be around. >> I know. >> Maybe I'll come back in four years. I don't know. >> When you're a lawyer. Yes. >> I don't know yet. So I think you know my past experience Please take your seats. Thank you very much. Uhhuh. We are on item number 14, public hearing. A public hearing acceptance of the Teamstster's local 150 2025 to 2026 school year proposal to the BerryUSD government code section 3547. Superintendent, please. It is recommended the board declare a public hearing and accept any comments from the public regarding the Teamsters Local 150 202526 school year proposal to the Beressa Union School District. Thank you. Public hearing
is now open. Are there any comments? If not, public hearing is now closed. Thank you. 15 is item 15 is review and action superintendent on Roman numeral one board policy 0410 non-discrimination in district programs and activities superintendent please it is recommended the board review and approve board policy 0410 non-discrimination in district programs and activities for first reading. Um this policy is just bringing language up to date for uh new um title nine regulations. >> Thank you. Any comments from the board? If not, may I have a motion to approve, please? >> Move to approve board policy 0410. >> Thank you. >> I'll second it. >> It's been sec. It's been seconded. It's been moved and seconded. All in favor say I. >> I. >> Opposed. Motion is approved. B. Human resources uh Roman numeral one
acceptance of the Timser's local 150 2025 2026 school year proposal to the berry USDA government code section 3547. Superintendent please. >> It is recommended the board accept the teamster's local 150 proposal. >> Thank you very much. Any comments from the board? If not, may I have a motion to accept? >> Move to accept. I'll second that. >> It's been moved and seconded. All in favor say I. >> I. >> Oppose. Um B Roman numeral 2 proposed 2026 2027 school year calendar. Superintendent, it is recommended the board adopt the 2627 school year calendar. Um this calendar recommendation comes from our um
calendar committee. I'll ask uh Mr. Cabrera, is there any um change or anything new with this calendar being proposed? There is nothing new in terms of the breaks. Um the be the what's new obviously is the beginning of the the first day of school and the last day of school, but the breaks that are there coincide with the breaks that East Side Union also has. So that way our students can take the break at the same time. >> And I do believe East Side Union made a change in one of those breaks. >> Okay. >> If you could share what that is because that's a change for our community. the veteran the veterans >> the spring the spring break. >> Oh yes. >> Yeah. The spring break. Um we try to do it as close
as we can to Easter, but because of the way the high school ter ends their quarters and semesters, it doesn't always get close to that. >> I see. Thank you, Mr. Cabrera. Any comments from the board? Yeah, I mean I have I have a comment and about the specific uh syncing of calendars within I know when my kids were uh here we had trouble with syncing our holidays it was very difficult and I was very happy that it started happening and I'm disappointed on behalf of the community that it's not happening anymore and it's it's it's a it might be it might a minor thing but you know it impacts a lot of families because you have two weeks um of you know daycare or whatever care you need need to figure out uh for
the kids and also you cannot plan any uh vacations and things like that so little disappointed I understand you know these are technical challenges as uh but hopefully uh in subsequent years we're able to um get back in sync as somehow >> well for clarification This is in sync with East Side Union High School District. The vacations mirror the ones that they've set forth on their calendar. >> so they are they are the same. What's different is in the past it's been just a tradition that spring break has always coincided with the Easter holiday. Okay, that is no longer the case. um East Side Union High School District is looking at uh a set of weeks between grading periods and that's how they're defining the breaks which is what caused this most recent change. >>
So uh so you're saying that um our break is also not coinc >> correct because it's mirroring it's mirroring the high school so our families could have the same vacation. >> I misunderstood. I thought I thought we doing one thing and and they're doing it. Thank you. That's very important and you know it's personal for me so I appreciate that. Thank you. >> Could I have a motion please? >> Move to approve. >> I'll second that. >> It's been move and seconded. All in favor say I. >> I. >> Oppose. All right. The motion is adopted. Now it is B Roman numeral 3 proposed 2027 2028 school year calendar. Superintendent please. It is recommended that the board adopt the 202728 school year calendar as proposed by our calendar committee. >> Thank you. Any comments from
the board? If not, may I have a um motion, please, for adoption? >> I'll move to adopt the calendar. >> Second that. >> It's been moved and seconded for adoption. All in favor say I. >> Opposed. All right. Motion is adopted. Now we'll go to education services Roman numeral 1 board policy 5125.1 release of directory information. Superintendent please. >> Thank you. It is recommended the board review and approve board policy 5125.1 release of directory information for first reading. And this update um in particular just continues to uh reaffirm the importance of student privacy and their information in uh directory uh data that we might provide to others. >> Thank you. Any comments from the board? If not, may I please have a motion for approval? >> Move to approve board policy 5125.1. >> I'll second
that motion. Thank you. It's been moved and seconded for approval. All in favor say I. >> I. >> Opposed. Motion is approved. Let's continue to education services Roman numeral 2, new exhibit 15125.1 release of directory information. Superintendent, please. It is recommended the board review and approve new exhibit 1 5125.1 release of directory information for a first reading. >> Thank you. Any comments from the board? If not, may I please have a motion for approval? >> Move to approve the exhibit. >> Second. >> It's been moved and seconded for to approve it. Now, um all in favor say I. >> I. >> Oppose. Motion is approved. Oh, 16 requests. Are there any requests for staff followup from the board? Are there any items for future agendas from the board? >> Yeah, in light of trusty man's
announcement. >> Probably should look at filling his position. So, maybe the next few weeks, maybe for the next board meeting, we should have an update on what we could do to to fill the vacant position. >> Yes, noted. Thank you. Thank you, Trustee. Superintendent, do you have any comments on that? No, thank you. Um, we've had the opportunity to go through a vacancy in the past, so we can definitely reiterate those steps for the board and how we will proceed moving forward. Thank you. >> Thank you very much. Um, item number 18 is adjournment. Um, >> Move to adjourn. All right, let's see. It's been moved and seconded. And now um before I continue with our adjournment, I just want to thank you again, Trusty Himemen is my pupil um for being with us and
I'm sure we will all miss you. Thank you so much for your service. >> It's been my pleasure. Thank you. >> Thank you so much. Uh we are now adjourned at 7:54 p.m. Thank you and good evening everyone.
