thousands of children and families with infant, toddler, and preschool. Uh mostly full day, fullyear child care. Uh I'm excited uh about the opportunity to bring that to Toyon Elementary where we'll be serving somewhere between 150 and 200 infants, toddlers, and preschoolers. uh as well as uh being a part of a really amazing partnership uh with the district uh with the um Children's Discovery Museum of San Jose and many other partners. We think that um you know what the superintendent uh is building uh on that campus is going to be a model that we can all be proud of. Um so thank you for your consideration and we look forward to a really long-term partnership. We've got partnerships with school districts all over the Bay Area. Many, you know, that we've had multi-deade partnerships with. Uh

Could I please have a motion to approve the consent calendar? Move to adopt the consent calendar. Second. It's been moved and seconded to approve the consent calendar. All in favor say I. I I oppose. Motion is passed. Um item number 10. Oh nine. Oh nine. Comments from the public on non-aggenda items. We have none. Oh, in that case we shall go on to item number 10. Reports and presentation. A measure U. Construction bond program updates. Superintendent please. Thank you. I'd like to invite Tony Connistab, our director of bond facilities, who will share with you his monthly report. Hello. There we go. Um, we'll go through the month report. I know I

wasn't here last month, so we might cover kind of two months worth of work. Um again this picture is of the new fencing around uh at Vincy Park by classrooms one and two. So now the whole campus is enclosed with security fencing. Um go again we'll go through all the projects. Again the one of the big projects we did was relocate the data center from the old district office to Piedmont. And again the IT department did a did a great job. Kyle and Matt both worked long hours to get it done, but it actually went really smooth. Um, we finished the field upgrades at Northwood. Again, monument signs at all the schools, our elementary schools, the PA projects at Brookree and Ruskin were completed. Again, exterior fencing at Somerdale. I think we have a picture

of that. All the hydration stations at the five schools were added. Um, and the parking lot at the old that was actually completed in like a week and a half. It was just amazing how fast they went through. Um, again, some of the the all the comprehensive or part of the comprehensive infrastructure renewal project. So, all the portables that they were replacing the Bard units on, they completed over actually the spring break. Um, modernizing of the portables at Majestic and Vincy Park, excuse me. We actually completed those so far. So, they're all ready to go for the summer or for next fall. um interior doors at the sister schools, all the double doors that go into the pods, those were all replaced. Um things that were out to bid now, and I just realized when

I was going through this before, these are actually part of the school consolidation, so they're not actually part of the bond, but we actually bid these in May and they're on the board for approval tonight. Um things that are out the bid is the warehouse project that will come to the board on August 18th. We'll start probably September 1st. Um HVAC at the old district office that should be done by the end of the month. Window project has started again at Piedmont. They'll be done by the end of July. Um, fire alarm at Vincy. Again, they should be done. I mean, they'll be done by the end of July for sure, but um replacement for PA for Majestic Way, Somerdale and Vincy Park. Somedale and Vincy Park will be done by the end of summer

and then Majestic Way will be finished during the year after after hours. Um, siding for Vincy Park and the painting of the siding at Vincy Park, that's actually started that'll be completed by the end of summer. um the comprehensive renewal projects, more projects. So, basically the big project at Brookree where they're taking out the central plan and replacing with new units that has started and that'll be done before teachers arrive or before school starts, put it that way. Um and then at Toyan, they actually started there also. And the solar projects, the central kitchen, we're just waiting to hook up with PG& so we can turn it on. this building. We I think we're planning on July 11th to actually turn everything on to switch it over. And then Piedmont and Sierramont that'll be done

before school starts next year. Um additional storage at the pods, they're actually starting that tomorrow. They're going to demo all the case work and all the um um electrical that needed the the uh units themselves come in July. so that we again we'll be ready for school. Um things that are in design the remaining of the security projects the last three um PA projects at Noble Sierra Northwood um Vincy Park that modernization project actually just got approved by DSA yesterday I think. So we'll put that out to bid and we'll probably do that we might do some of it next year but definitely next summer. Um payment improvements again we'll put that out to bid in the fall do that next summer. um the kitchen assessments. Soon as we get them done with all the

moves, we'll start working on all that stuff. And then the firearm replacement, again, that's already been approved by DSA and we'll put that out the bid for the fall. And then these are the last projects for the comprehensive infrastructure renewal. Again, Majestic Way and Summerdale. I know Majestic Way has been approved by DSA, and I think Summerdale is in the final stage. So again, we'll do those next summer. And solar at Cherrywood and Lane View, those are going to happen after summer school and they'll be done by um Lane should be done by September 1st and um Cherrywood at I think October 1st at the latest. And again, here's pictures of the Vincy Park portable. This was the Sunshine School where there used to be one big classroom. We converted it into two classrooms. We

added that wall in the center. Um, again, this is the fencing at Somerdale around portable P1. So, again, now all those portables are enclosed so nobody can run around and get out. Um, this was the mockup for Vincy Park. What the wall is going to look like. It actually turned out pretty nice. Again, this hasn't been painted, but again, it looks 100% better than it did before. Um this is the wall we added at Majestic Way at the MPR. And these this is one of the windows sets of windows at um Piedmont. Um again, you can see where the two are frosted and the top's clear. It actually turned out pretty nice. I mean, better than I thought, but I'm I was really happy how it looks because it still lets a lot of light

in and it just makes again now we don't have mini blinds or anything anywhere again. And then this is Pedmont, the parking lot, and just a schedule of what we have left to do. Any questions from the board? Any comments from the board? Oh yeah. Uh thank you so much for your presentation and welcome back. Always looking forward to these presentations that you have. Um the projects always look amazing. Um one of the questions that I did actually have um I received a couple of questions from um teachers talking about how in the next school year we're going to address um elopment noise um with our special education students as they enter the our schools with pods. And so I just wanted to ask um you know how we're addressing that and their concerns. So,

we are doing this summer at Majestic Way, we are doing one pod where we're going to try adding we're going to put in some walls. So, we're not adding doors, but we're actually going to make it so that you can't see into each pod and we're going to see how that works. And if that works out well, then we'll do that at all with pods. Yeah, it's reconfiguring the entry because currently when you go into a um a pod setting, all three classroom entries are right adjacent to one another. So, it'll be um redeveloping that entry so they're now moved at opposite ends. So, you'll have one on each end and one in the center uh for a few things. for one, hoping that that would then minimize some of those concerns about children quickly

aloping from one classroom into the next one. Um, but then also to see to the extent that that helps buffer some of that um that noise that carries up currently from that concentrated opening. So, we'll try it. you know, we're not sure um how it'll work, but we have a a classroom teacher volunteer who said they'll give us feedback and so that'll be the pilot site at Majestic Way. Thank you so much and thank you for your work on coming up with that pilot and I creative idea. Thank you. Any more? None. Just wanted to thank your thank you for your leadership and you know your awesome work throughout the years. It's been you don't I really like trusty hogs said I look forward to to these presentations and most of the time since I've

been on the board I've been the one asking you a lot of question much to your you know dissatisfaction but I I I know I hung up you know I was like so hung up the camera issues when we were putting up cameras kept asking you about and I appreciate you you know giving all us all the information all the relevant information and you know thanks for all your hard work. Thank you very much for your presentation and I thank you for everything you've done. All right. Thanks. We shall continue to item 11, the superintendent's report. Uh Dr. Fuentes, please do you have any? Yes. Um first just of course want to continue to extend our congratulations to all of our eighth grade students. We had wonderful celebration. It seems like it was so long

ago, but it was just last Thursday, you know, that we got to see them off and on to now their their high school journey. And all of our other students that hit their milestones as well, you know, our fifth graders promoting on to middle school, our kinders, our TK's moving up to that next, you know, that next grade. Um it's just always a a good time to wrap up another year of learning and you know um extend our thanks to the children for working hard and trying to learn as much as they can and then also thanking all of our staff that support them you know each and every day to make sure they have a positive uh learning experience. I also want to make sure um you know this was an unprecedented year uh

with lots of challenges and just want to make sure I give my thanks and gratitude to our cabinet team who has really done um a lot of above and beyond uh planning and organizing and problem solving uh with things we didn't know to anticipate. Right? So uh you know none of us have gone through school consolidation to this scale and so it's a learning opportunity for all of us and I just want to um you know give my appreciation to our our cabinet uh for working through you know all of those situations and and coming up with solutions that ultimately will best serve our students um in this transition. and looking forward to starting off next school year in as positive a way and as supportive of a way as possible for everyone. Um, and

as you heard from Tony, there's lots of work in progress and there's going to be lots of movement this summer. So, lots of uh mobility back and forth and you know uh just looking forward to getting everything reconfigured and and right-sized and you know there's a lot of folks that are going to be involved in that process and so we know um again you know want to thank them for their their late hours. I I think Tony and Bonnie were here beyond me and you all know how late I stay and they were still here when I left last night. So, lots and lots of things to get on the summer schedule to make sure that these projects get completed and that everything's ready for the first day of school. So, just want to say

thank you for all of that hard work and and diligence with external third parties that we have to rely on to make sure these things get accomplished. Um, also, you know, we're already ready to start summer school. So, you know, while all this activity is happening, we'll have children welcomed back next week on Monday. So on Monday, you know, kids will be back uh both for academic learning and support and also as part of our ELOP extended care programming. So, you know, we appreciate all of our staff that signed up and said, "Yes, we're willing to be summer teachers and summer support staff to ensure that we have these opportunities for our students." And um also many of you, you know, I'm sure were very aware of, you know, the fire that took place last

night. We were closely monitoring that situation to um make sure, you know, our schools uh you know, what vicinity they were within the evacuation zone and all of that. You know, I have to say I'm very impressed with San Jose Fire Department. Um they were very responsive. Uh, I know I was at a community meeting last night and um, Captain Zuniga from San Jose PD was there and was very clear about the coordinated response and actually multiple drills that um, our emergency response teams have practiced for exactly what occurred yesterday. And so, um, really efficient, really glad that, you know, all of our neighborhood families weren't impacted uh, too terribly and that everyone was safe in that outcome. But wanted to give, you know, our thanks to our community service providers, our emergency response teams,

and grateful for the communication that they offer to us as well. And then finally, um we do have a new neighborhood association um in the area, Beautify Beressa. They invited me to be u a guest speaker at their meeting last night. Um just to provide an opportunity to clarify information regarding our school consolidation process, but also to get an update on, you know, our our um school sites that have closed, you know, what's going to happen with that property and what are some of the district plans. And so it was nice to be able to talk with them and share with them about the opportunity for future community services at these locations as we engage with different potential tenants for each property. So um it was a nice opportunity to just uh engage with our

community through through that venue. And so with that, you know, we're ready to keep at it. You know, schools are closed, but the district office is not. We will we will continue to be here and continue to u make sure everything's ready for the next school year. Thank you Dr. Fuentes. And I also would like to thank members of your cabinets because you work so hard for all this especially during this year which was pretty much of a a very challenging time with the with the uh consolidation and also to all the teachers. I hope they get a chance to relax um and ready to come back in August. And of course the classified staff, I'm always very grateful for them because they always they always stay up late to make sure that everything is

ready for the next morning and for that I thank you. Um item number 12, any comments and announcements from the board? None. No none. Okay, we shall continue uh review and discussion of item number 14 is public hearing a public hearing on 2025-2026 local control and accountability plan uh the LCAP. Superintendent, please. It is recommended the board declare a public hearing and accept comments from the public regarding the adoption of our local control and accountability plan. Thank you. I'm going to open public hearing is now open. We have one. Oh, you have we have um Oh, we have a speaker. All right. Thank you. Um before I I ask for the speaker to come. I would like to read the speaker conduct. For all who wish to address the board during public comment period, speakers

are requested to state your name and affiliation for the record. Each speaker will be given three minutes to address the board, five minutes per organization, and a maximum of 20 minutes per topic. However, in exceptional circumstances when necessary to ensure full opportunity for public input, the board president may with board consent adjust the amount of time allowed for public input and or the time allotted for each speaker. Any such adjustment shall be done equitably so as to allow a diversity of viewpoints. The president may also ask members of the public with the same viewpoint to select a few individuals to address the board on behalf of that po viewpoint. Board bylaw 9323. Speakers are reminded to communicate with respect, fairness, and courteousness to each other and to all present. We ask that you not use

the name of any district employee in your comments. The board welcomes orderly communication from the public. Thank you. The speaker is Cindy Panelli. Cindy. Good evening, superintendent, cabinet members, and um board. Um, my name is Cindy Panelli and I'm an instructional coach as well as the AVID district director and I'm here this evening to advocate for our AVID tutors um for the um during the LLPAC for the 2025 2026 LCAP PL LCAP plan. Tutors are not own just not just a part of the AVID program. They are the backbone. For the past six years in Beressa, our tutors have provided critical academic support guiding students through challenging concepts in our core in their core classes. Through structured and small group tutorials using open-ended questioning, tutors empower students to independently discover solutions and deepen their understanding.

Tutorials also are support our students who are in the red and the um our California um data dashboard in mathematics. Beyond academics, tutors serve as mentors, fostering essential college and career readiness skills such as time management, organization, collaboration, and effective note-taking. These are skills that are vital for our students to be successful. Just as important, our tutors also serve as role models, showing our middle school students that there is a clear path to higher education or a skilled trait. In reviewing the 2024 2025 LCAP document, section 2.15 explicit explicitly allocates $33,636 for AVID tutors to support classes for up to two hours daily. Yet, despite the designated funding, the district only utilized onethird of these funds this past year for one single tutor. The other two tutor positions were regrettably frozen last year due to

a district-wide hiring freeze. This is particularly confusing given the clear financial allocation and the immense need for these tutors. The consequences of having only one tutor this past year meant that their time was spread across two out of our three middle schools which significantly in impacted the effectiveness of the AVID elective classes. It's simply not possible to provide 100% of support to any one school when the resource resources are stretched thin. As you deliberate and prepare to vote for the 2526 LCAP plan, I strongly encourage you to not only preserve the crucial funding for AVIT tutors, but also unfreeze the two tutor positions. This would ensure that we can place at least one college age tutor at each middle school. Thank you for your time and consideration of this critical investment in our students future.

Thank you, Miss Panelli. We shall continue with public hearings, which is letter. Oh, yeah. I'm sorry. Public hearing is now closed. Thank you. All right. Letter B, public hearing 2025 2026 budget adoption. Uh, superintendent, please. It is recommended the board declare a public hearing and accept comments from the public regarding the adoption of the budget. Thank you. Public hearing is now open. Do we have any comments? None. If none now I am going to close the public hearing. We shall continue to letter C. Public hearing district's initial proposal for negotiations with the California School Employee Association CEA Chapter 3 364 unit according to government code section 3547. Superintendent, please. It is recommended the board conduct a public hearing and accept comments from the public regarding the district's initial proposal for negotiations with the California School

Employees Association, CSEA, Chapter 364. Thank you. Public hearing is now open. Do we have any comments from the public? If none, public hearing is now closed. Thank you. 15. Review and action. Uh, Superintendent Resolution 24-26 supporting Senate Bill 743, uh, the Education Equalization Endowment Act. Superintendent, please. It is recommended the board adopt this resolution supporting Senate Bill 743. Um, this resolution is is authored by Senator Dave Corteesy. Um it has been endorsed by the Santa Clara County School Boards Association as well as AXA region 8. Um and what this is it's an attempt to equalize to some extent uh funding for state funded school districts. So, Senator Cartees is bringing to light uh to the legislature that there is an inequitable distribution of funds when you compare community funded school districts to state funded school

districts. So, as uh an opportunity to engage the legislature in this disparity, he is proposing this education equalization act. So in a given year, if there's additional resources, he is advocating for the legislature to redistribute those resources to state funded school districts so we can potentially come up to par as our community funded neighbors. Um to be clear, it's not advocating that any funds be taken away from our community funded part uh you know uh school districts, but that when there's an excess uh there be an arrangement made where those funds can come to um to state funded school districts. Thank you for that. And any comments I have a few comments. Go ahead. It's more like a rant and I I shouldn't have gone down this rabbit hole uh trying to u make sense

of this this but I did and I I thought I'll share share my frustration with u with this thing to to make it clear I will support the resolution I don't I'm not against the resolution I will vote yes on it but just to share with the community the the challenge of why why we are here, right? I mean, it's it's it doesn't make sense. Um, so so first of all, this the bill the provisions of bill is not very clear. It's very vague. I don't know whether any of you had a chance to go through it or anyone in the community uh has had a chance to go through it's very vague. Uh the the funding formula is not clear. Um the distribution formula doesn't exist. We don't know how it's going to be

distributed. Um so if if the legislature is really really serious about funding schools, they can do it today. They shut off that that you know crazy project called this highspeed rail over there siphoning off billions of our tax dollars. Uh 2008 we passed the resolution to to um build that highspeed rail. 17 years passed. we don't have a single foot of track late uh and we have spent $23 billion so far uh in that project and and the reason I'm I'm pointing to that I mean we have several projects across the state the reason I'm bringing the highspeed rail project is because uh Senator Cortezy uh we know him he's a nice person he's very u he's very interested in education and so on he's also the chairperson chairperson of the Senate transportation committee who

oversees these transportation projects. Um, it should be easy enough for him to to don't siphon off the money uh to a project that's that's not never going to be completed ever. As far as I'm concerned, it's you know, they're trying to connect Merrced to Bakersfield. I don't know for what. Uh, it's not going to increase any economic activity in the state or nothing. Um, at best it'll connect cows in the two two cities. It doesn't make sense to me. is from connecting, you know, nowhere to nowhere. At this point, at this point, it's just more of a ego boost than anything else. It's just a waste of our tax dollars, just sending our our tax money there. And the reason I I bring that up is because u this question was put to Senator Cotesy

at at a uh Santa Clara County School Board Associations uh event recently. Uh some of the members did question you know why why are you sending money there where you can you can fund our schools you know uh you know create achieve this inequity and all that stuff and his answer to them was to you know it helps create jobs in central valley. Um and my question to him was uh why is my tax money that we generate over here not coming back to us? you know, should come to fix our roadways, fix fun spend our schools. I don't want to send my money to Central Valley to create jobs there. And these are not jobs like private sector jobs. These are taxpayer funded public works jobs, right? They're not building Safeways or Walmarts there,

right? And it's it's frustrating because the reason it it was more and more I I kept thinking about it is because it's frustrating because when we went through our consolidation process, several members of our community reached out to us by email. Many of them spoke at our meetings and then they itemized our expenditures. They looked at our budget saying that you're spending, you know, $100,000 in in this thing, $20,000 for a copier contract, $70,000 for for security person, $200,000 here and there. But we have no idea where this $23 billion have been spent. Nobody questions our state legislators where this money, how this money is being sent, spent, who is getting this money, why why don't we ever have any results? It's just it's frustrating. So you know my advice to the community is just

be engaged with the legislator. Just try to find out where the money is going and why we are being told that you know there's no money to pay the teachers well where everybody that runs for office says that you know we want to pay the teachers we want to fund the schools and so on but but they approve sending money elsewhere that is um doesn't make any sense. if it made sense, if it, you know, boosted the economic activity in the in the state, I'm all for it. But, you know, this is just a boondoggle of a project that that's not going anywhere. And it's just frustrating. Like I said, I wish I hadn't gone through jumped into the rabbit hole, but I did. And I tried to make sense of the uh of the

bill. I think Senator Cortezy himself was surprised when it passed the uh the um committee. I think first award to the committee is probably be surprised that it pass. We all know that it it's the the bill is not going to go anywhere. This independent analysis that has happened but to the extent that it's it's pointing out a obvious thing that everybody should know, everybody in the legislature should should know that you know schools are not being funded. Everybody runs for for higher office with the promise of funding schools. I don't think we need a bill to highlight that. Right. But so that's that's my, you know, five minute rant on this thing only because I I I went into that, you know, I I made the mistake of opening that the language of the

Senate bill and try to make sense of what it is and I I couldn't I couldn't understand why uh we are in that process we are doing that. But anyway, but my advice to the community to whoever is listening is stay engaged with your with your uh elected officials and try to find out you know we are we are at the you know bottom of the totem pole so to speak as far as expenditure is concerned. We don't print our own money. We don't generate anything ourselves. Uh but you know all our tax money is going to the state and you know they're doing things that we don't even know. We don't even question ever. um and it's frustrating. So, thank you for listening to our Thank you, Trusty Shinasan. Um Trusty Hog, you have

another comment. Go ahead. Yeah. Um my comment is just um I'm really supportive of this bill because what it does is that you know in the legislature um we know we were talking about the budget earlier and this is mainly for the community's benefit. There is a minimum spending that the state has to do on education. And so what this bill does is if there is excess funding um that exceeds Prop 98 requirements or the minimum requirements they need to spend on school, they will put it into an account and then the money in that account will be distributed to schools who do not receive as much money as like a basic basic aid district or like a district that has so high property taxes or a lot of money in the community where their

schools really don't need to rely on the state funding them. And our district in Beressa, you know, we are like a state funded school, meaning that, you know, we receive that minimum requirement from the state on how much money they think that we should receive based off of our economic um picture of our community. And so this would be really helpful to us if it passes. And so I'm really excited that they're doing this bill. the funding formula for um school districts um was created in a way that was not necessarily representative of the high cost of living here in the Bay Area even though our school district is funded by that um minimum funding allocation by the state that they think okay like if a school district receives this much money they'll be fine

um you know obviously that is not the case for us because of how expensive it is to live here you know declining enrollment all of the things so really happy that we're doing this and um thank you to Senator Cortesi for pushing for this. So yeah, so thank you for just quick question. Do do we know uh if the the bill does pass, do we know uh do we stand to benefit any? Do do we because according to me because there are school districts uh that are worse off than us. There are people funding that are worse off than us and there are many of them and it'll probably take several years to fund that reserve account. Mhm. And for us, you know, I'm know I'm being selfish, but you know, for I I I

look for best interest of of our school district. So, do we have any idea of whether we at all we will be Yeah. So my understanding is because and I know where you're coming from in the sense that with other funding opportunities, we often learn, oh, Beressa isn't eligible or, you know, we're at a because our unduplicated per pupil count, you know, is at a certain level, we're not eligible for those funds or we're going to like we talked about ELOP earlier that we're in a tier 2 status, so we're going to get what's left. So my understanding is that for this allocation it would be given to all state funded districts. How much money would that be? It depends on what's available, but it would be equally distributed to all state funded school districts.

Uh I haven't heard of any tiered um allocation system involved in that. Yeah, when I was reading the bill analysis too, it doesn't say necessarily in the bill how the funding is going to be distributed. It just says, you know, further legislation required. So, we'll see. That's where my problem is because we don't know where the how the aortionment will be, right? Which is which is open interpretation and and I think you know and I I understand that frustration point of not understanding well what because you're wanting to see well what is that bottom line for our school district like what is that benefit? But knowing that there have been ongoing back and forth conversations in the legislature, um I think this is one way to also reconsider what those opportunities can look like and

to make sure that this conversation stays alive because we know that coming out of um the pandemic, dealing with declining enrollment and all of these other factors, our current funding formula is not working for us. that is very clear. Yeah. Um there have been, you know, um conversations in the legislature. Do we need to change that funding formula to go from attendant uh you know uh monitoring daily attendance versus enrollment? You know, and we know that there's a lot of research that needs to be done in that arena to see well, you know, would that be a better benefit to all districts? Would that change who benefits and who doesn't? What's that percentage? Right? So, it was a very um lively discussion probably two, three years out of the pandemic, but it hasn't been as

lively any longer, right? Yet, just look at this year and all of the different districts we're seeing going through school consolidation and many others, right? I I'm getting phone calls all the time from superintendent colleagues now. Tell us about your process because we're getting ready to start ours. So this is um where I say, you know, at what point does the legislature sit up and see there's a domino effect happening across the state of California and something needs to be done about it. This is one avenue that could potentially even without a formula be a quicker resolution temporarily until that larger conversation can be defined with ultimately having a funding formula change. Right. And I think I if I um recall correctly even this even this budget year the governor is looking to reduce the

Prop 98 funding too. So the the um reserve will be funded on in whatever is excess of Prop 98 dollars right so so like I said it's going to take some time to build that reserve to make a meaningful impact for for our school district. So, and my thing is, you know, we have the money. If we have the money now to to not build stuff, to send money somewhere, to not build stuff, why not use it to, you know, use it positively to to fund the schools that we have is where um where I landed and I didn't know what else to do. So, I use this opportunity to share my thoughts on that. So, thank you for listening to me. Thank you all for your comments. Very good discussion. We shall continue. This

is a resolution. Could I have a motion for adoption? I was moved to adopted resolution 2426. Second. It's been moved and seconded. Um, Miss Gomez, please. Roll call vote. Yes. President Back. I. Trusty Jimenez. Hi. Trusty H. Hi. Trusty Nuin. Hi. Trusty Trinasan. I thank you very much. The resolution is adopted. Let's continue on to A2, resolution 24-27, recognizing June as LGBTQ Pride Month. Superintendent, please. Thank you. It is recommended the board adopt resolution 2427 recognizing June as LGBTQ plus Pride Month. So, happy Pride Month that we did um in response to the resolution that was passed uh last school year. We've been honoring all of the tenants that were outlined um that are also reflective in this resolution um which included the raising of our Pride Progress flags at um each of our school

sites and our district facilities. Thank you very much. Could I have a motion, please, to approve or to adopt? Oh yes, I'll make the motion. And I also have a quick comment, too. I just want to also say um thank you for work on this resolution. It's the same one from last year, just updating, you know, the dates and everything. And I actually got the opportunity um in the first week of June to visit Pedmont Middle School. Um their GSA was so excited to raise the pride flag. I brought breakfast burritos for everybody. This the students were so excited to raise the flag. We were able to hand out um rainbow lays, rainbow um beads and then we had a little resource fair during lunchtime and I've received a lot of positivity. A lot of

um students have been really happy um with the inclusion that they're seeing more now. And you know, I invited some students to come tonight to speak in support, but you know, one thing that they said to me that I wanted to share with the board and the community was that, you know, they're scared to come in public to talk about um you know, supporting a resolution like this. you know, they're not out to their family, to their parents. And I think that, you know, that just goes to show the salience and the importance of this issue. You know, we have um students who are wrangling with their identity and they don't necessarily feel welcome at home, but you know, they feel so welcome and so loved at school and you know, that's what we should

be doing as a school district. You know, continuing to celebrate our diversity, making sure that we have safe spaces. is I want to say thank you to Miss Mayo who also um has been so active at Pumont Middle School. Um really advocating for our LGBTQ plus community and even seeing the pride flag like throughout the school site too is really exciting. I was able to visit a month ago as well and so just really happy that um we're having these conversations we're having our students feel um more included. You know, they're so excited to um be able to express themselves on our school sites. So yeah. Happy Pride everyone. Thank you very had some comments so I'm still not on board with Go ahead. Sorry. You have a a motion but not a second. Second

have comments. We move on and seconded. Okay. Allow discussion. So I'm still not not on board with the with the PRI progress pride flag uh at our school sites. Perfectly fine with it at our um district office. I think we should have that uh for sure. Uh specifically the elementary school sites. I'm not fully uh supportive of that and some of the uh uh provisions of the resolutions that I don't uh agree with some of that, but that's that's okay. Uh but specifically with the the pride flag, I think we should uh keep elementary schools out of it. But uh that's my minority opinion. I I understand. So I will be abstaining from voting on this. Right. This is a resolution. Therefore, we need an a roll call vote. Miss Gomez, please. Yes. President Boak,

I. Trusty Himenez, I. Trusty H. Hi. Trusty Nuin. Hi. Trusty Shinasan. I'll abstain. Thank you for that. The resolution is adopted and it is 4 to one abstension. Thank you. We shall continue to B which is for business services. The resolution 2422 year in budget revenue. Superintendent please. It is recommended the board adopt resolution 2422 year end budget revenue. Thank you very much. Any comments? Do I have a motion? Move to adopt resolution 2422. Second. It's been moved and seconded. Again, this is a resolution. Miss Gomez bless please for roll call. Yes, President Boak I. Trusty Jimenez I. Trusty How. Hi. Trusty Nuin. Hi. Trustee Shinasan. Hi. Thank you very much. Uh resolution is adopted. Um two are we in the budget already? Yeah. Resolution 24-23 year end budget expenditures. Uh superintendent please. It is

recommended the board adopt resolution 2423 year end budget expenditures. Thank you very much. Any comments from the board? Do I do I hear a motion for adoption? Move to adopt resolution 2423. Second. It's been moved and seconded. Miss Gomez again, please. Roll call. President Boak. I. Trusty Himenez. Hi. Trusty H. Hi. Trusty Nuin. Hi. Trustees. Hi. Thank you very much. Adopt the resolution 24-23 has been adopted. Now, let's go to three. Resolution 24-24, Education Protection Account. Uh, superintendent, please. It is recommended the board adopt resolution education protection account EPA funds allocating revenue received from the EPA to teacher salary expenses. Thank you very much. Any comments or motion from the board? Move to adopt. I'll second. It's been moved. It's been moved and seconded. Um Miss Gomez again, please. Roll call. President Boak. I trusty

Jimenez. Hi, Trusty H. Hi, Trusty Nuen. Hi, Trusty Shernawson. Hi. Thank you very much. Um, resolution 24-24 is adopted. Now, I think we're going to four. Resolution 24-28, Superintendent and Assistant Superintendent of Business Services, authority to execute contracts for the bond program and MOT department. Superintendent. It is recommended the board adopt resolution 2428, superintendent and assistant superintendent of business services authority to execute contracts for the bond program andot department. Thank you very much. Comments or motion from the board? Move to adopt. All right. Go ahead. Move to adopt. I'll second that. It's been moved and seconded. Miss Gomez again, please. President Boak I. Trusty Jimenez. Hi, Trusty H. Hi, Trusty Nuin. Hi, Trusty. Hi. Thank you very much. Resolution 24-28 has been adopted. Um five DC Electrical Company, Inc. Agreement for bid B-08-2024-25 site work

and utilities for newly relocated portable buildings at Majestic Way Elementary School. Superintendent, please. It is recommended the board approve the DC Electrical Company, Inc. Agreement as stated. Any comments or motion from the board for approval? Move to approve uh the agreement. Second. It's been moved and seconded. Um, the board has approved the DC Electrical Company agreement. Let's continue. Huh? You need a vote. Oh, didn't we vote on that one? Oh, all in favor say I. I. Oppose. All right, it's been approved. Thank you very much. It's just a resolution that got me all there so many of them. All right. Thank you. Six. Kadango, Inc. license agreement to operate a preschool on a portion of the campus at Toyon Elementary School. Uh, superintendent, please. It is recommended the board approve the Cadango, Inc. license agreement

to operate a preschool on a portion of the campus at Toyon Elementary School for 5 years. I also would like to add some additional information on this particular item. Um, as you heard earlier at the start of the meeting, uh, Scott Moore, CEO of Kadango was here, shared a little bit about, um, their company. It's a nonprofit state preschool provider. And so, very exciting to be able to offer that service to our community. Currently, we do not offer state preschool in Beressa Union. So, this would be a great advantage to all of our our young uh, toddlers. They also service infants as well. So great child care um support. Uh families that are eligible will be eligible for scholarship so that they can get that preschool learning and child care for free. And they will

also have um feebased options as well. But what I want to also highlight is that the potential for this project is beyond just offering state preschool um opportunity for our community. uh we have many um interested partners that have wonderful uh vision to create an early learning center at Toyon. So, not only would there be um this the state preschool program, but in addition, we already have a confirmed partner with the Children's Discovery Museum who would be creating an annex location there on site specifically tailored for our young young learners. um that would be utilized not only for the children that participate in the Cadango program, but for our community at large so that they could come in um have that shared space and then have workshops and classes and lots of different activities um

including on the weekends. And so um Children's Discovery Museum has we've had lots of really great conversations of what that could look like. In addition to that, um we are also envisioning creating a family resource center at this location with other potential um providers. Uh we know of, you know, First Five is a wonderful nonprofit that provides excellent service and information to families about how to care for their young children, not just in the aspects of education, but also um health and physical well-being. you know, how to get your child ready for TK and kindergarten, um, including, you know, all the physical exams and going to the dentist and all the immunizations that they need. So, being able to have kind of a one-stop shop for families to be able to get all of that

information to um, help our early learners, you know, be be ready for school. In addition to that, we are also thinking beyond the Toyon site. And so when I say that um where Toyon is physically located, there is a lot of wonderful local natural resource around that area. You've got Penitencia Creek. You've got the Percula the Perk Ponds. You've also got the Alamrock State Park. So, one of the things that we're thinking about in terms of the curriculum that Kadango would offer to the preschoolers as well as the activities that the Children's Discovery Museum would provide would be nature and environmentbased and that we would take the children outside the school and work in partnership with the city and with the county and with uh Santa Clara Valley Water because everybody is orchestrated in those

lands. um to be able to create outdoor learning stations for children. So, that's kind of the the bigger vision um where it would all come together. And even in talking about what these um learning opportunities could include, you know, they can certainly support um field trip opportunities for our TKers, for our kindergarteners. um there's just going to be a lot of robust um opportunity for early learning there in that area. Uh it'll be phased out over a few years, but just incredible potential. And so I certainly um am really pleased that Kadango has come forward as being a lead partner in developing that experience for early learners. Thank you for that. Thank you very much. So could could I have comments or motion please for approval? I'll move to uh approve I have a comment.

I just you know wish Kadango a lot of success welcome to you know our neighborhood uh and I look forward to having them as a partner for long term hopefully a lot more than the five years. Yeah and I'll second that and I also wanted to add um thank you to Dr. Fuentes, thank you to President Boak, you know, for your leadership and visioning this new creative way that we can really give back to our community, especially in the Toyan neighborhood. Um, I'm a childcare advocate in my day job and so I'm really happy to see that we are doing something to really help our little littlest ones as they prepare for um coming to Beressa as potential new students as well. um as the studies have shown time and time again that development really

is crucial in zero to five. So it's really integral that we support our students in the best way that we can even as young as you know zero to five obviously and I'm really excited to have Kandango in our neighborhood. Welcome to Beressa. We're so excited to have them as a partner and really excited to see this moving forward. Thank you for those comments and I agree. Um, I'm looking forward to uh the partnership for the future. All right. Uh, motion, please. You have a motion. Motion already. It's already Oh, it's been moved and seconded. All right. In that case, um, all in favor say I. I. Opposed. The first time no one opposed it. Thank you very much. It's been approved. Motion is approved. Seven. Oves Construction Inc. Agreement for bid B-06-2024-25 site work

and utilities for newly relocated portable buildings at Northward Elementary School. Superintendent, please. It is recommended the board approve the Ovesy Construction Inc. Agreement, the lowest responsive and responsible bidder for bid B06202445. Thank you very much. Do I hear any comments or could I have a motion? Move to approve this agreement. Second. It's been moved and seconded. All in favor say I. Opposed. Motion is approved. C. Human resources acceptance of the district's initial proposal for negotiations with with the California School Employee Association CEA Chapter 364 unit. According to government code section 3547, a superintendent, it is recommended the board accept the district's initial proposal for negotiations with CSCA chapter 364. Thank you very much. Do I hear um do I hear a motion or comments from the board, please, for acceptance? Move to accept the proposal.

Second. It's been moved and it's been moved and seconded. All in favor say I. I oppose 520 to zero. It's been accepted. Um to resolution 24-25 declaration of need for fully qualified educators for the 2024-2025 fiscal year. Superintendent, it is recommended the board adopt resolution 2425, declaration of need for fully qualified educators for the 2425 fiscal year and approve a recommendation for a provisional internship permit for certificated staff members. Thank you very much. Any comments from the board? A motion for adoption. Move to adopt resolution 24-25. I'll second. All right, it's been moved and seconded. This is a roll call vote. Miss Gomez, please. President Boak, I. Trusty Jimenez, I. Trusty H. I. Trusty Nuin. Hi. Trusty Shuvasan. I. Thank you very much. Uh, the resolution 24-25 has been adopted. Motion is approved. Let's continue.

Education Services one, reading difficulties risk screener RD RS presentation and adoption. Superintendent, thank you. It is recommended the board approve and adopt the recommend the recommended reading difficulties risk screener. This is part of new legislation um in terms of our uh review and preparedness of students needs and any difficulties they might be facing in the area of reading. So, Dr. Mccuri has a brief presentation to share a little more with you about that and what this screener will entail. Okay. All right. So, tonight we're just going to go really quickly over the purpose of the RDRS and what we're looking forward to as we start planning for the implementation for next school year. But I wanted to give you some highlights of why we went through this process and um uh the teachers and other

folks who served on this committee and their recommendation. So the purpose here is to review the key aspects of the legislation and then also to um review the information that the committee went through in order to pilot and then um provide a recommendation moving forward based on the timeline process and feedback and then once again to seek the board approval at the end. And so this is a background of Senate Bill 114 um requiring all school districts to have an annual kindergarten through 2 grade screening in their primary language when available. We have to notify parents um before we um send this or we have to send information out to parents in order for them to understand what the screening is about. And then we as a school district have to um there's a list

of four screeners that were available and um the process that we went through and we have to do this by the end of this month and then it requires to be implemented in the 2526 school year. And so once again um the purpose of the screening is to flag potential risk for reading difficulties not as a diagnos of a diagnosis of a disability. So, we want to make sure that's very clear that um it's a screener to help support our primary grade teachers to um identify students who are really needing some extra support when it comes to early reading. Uh results from the screening shall be used as a broader process to evaluate the pupil needs and progress identifying supports for classroom instruction and then enabling targeted individual intervention is needed allowing for further diagnosis

if concerns don't get resolved. So here's the um timeline that uh the state has been going through over the past year and a half. So in January 2024, our um states went through a selection process in order to u move forward the four um different programs that were identified in May of 2024. And then actually they went through and screened all of the different um um pieces. And then in December, way at the end of December 2024, that's when the official list went out to school districts. And so once again, by the end of this month, we're to adopt one of the approved instruments from the list for all K12 students to be uh screened. And so then you have the 2526 school year where we're to implement to have all of our students um

tested. Okay. And then this um slide goes over the district's timeline for selecting the RDRS. You can see here in January and February of this school year got together with um our ED services director of curriculum and instruction and some of our um instructional coaches and we identified two of the actual um screeners that we were going to pilot and then those were multitudes and a mira. And then in March, we formed a committee of eight teachers to principles and there was a toolkit that we used and facilitated this process from the director of curriculum and a couple of our instructional coaches. And then those teachers went out into their classrooms and they piloted these two different um programs working with a handful of students to see how easy it was in order to make

sure that um whichever one we decided on was going to be easy to implement. So it wasn't a burdensome process for our teachers moving forward to next school year. And then we're here tonight to share our recommendation. So here are the two screeners that we piloted. Um once again multitudes and a mirror and then there were actual criteria that the teachers were supposed to look for making sure that you know strongly meets the needs of our students within the district. um areas about evaluation, preparing, how much time it takes to prepare for the administration of the actual uh test, what does that look like when we score and report and how easy it is to access the data once it's um given to the students. So overall ratings, you'll see here that um multitudes had

a very strong rating um adequate. So for the most part it was a 96% um favorable and Amira was like 83% favorable and then the team had to go through this consensus and decision-m process just to make sure that everybody was on the same page so that they understood um that you know everybody's voices were heard for the most part. So what were the concerns for those folks who uh didn't officially you know stand behind Amira. So once again that fistto five consensus protocol. So they went through each of the um teachers went through and made sure that once again they their voices were heard and the reason why they landed on uh multitudes was it was manageable to administer easy to navigate for the students use friendly to get started user friendly to get

started and understand the reports. The reporting tools were um effective. there were letters that we could send home to um parents in many different languages. And so next steps of course is what is it going to take to implement this in the classroom. So one of the big things is as we transition to next year these screeners have to be done within the first school year. So it doesn't necessarily mean that all of these tests have to be done within the first month of school. And so that's really the um recommendation. We're going to have an additional team brought together to really come together and really think through what is that um process going to look like and um hear from teachers, understand there's a lot of things going on at the beginning of the

year. Can we wait until October? Can we wait until November? specifically with our kindergarten students because at the beginning of kindergarten there might be a lot of students who don't do well on the screener because they've never been to school and so the recommendation specifically for kindergarten is wait until probably you know at least November December to administer this and of course there needs to be training and professional development for teachers um support staff also might be needed to be identified that speak another language other than English so we're thinking our um assessments um folks. We have one that speaks Vietnamese. We have one that speaks Spanish and then we also have our reading tutors that are at our um house at our sites as well. And then we also have to work with it

to make sure that all of this is coordinated specifically so that it can be done effectively. And once we get all that figured out, then we'll be able to administer the screener and then get the data to really inform the instruction within the classrooms. So those are the considerations and next steps that um the team brought forward. And then we just wanted to acknowledge all the hard work that the teachers that were on the committee went through and um our principles and instructional coaches that helped support this process as well. So the recommendation like I mentioned is for us to move forward with multitudes questions. Any comments from the board? I I just had a question. So the uh the what is it called the evaluation screener screener screener. So it's uh only applicable for

kinder to second grade. So kinder first and second every student within the district has to be tested through the screener. I was just curious why why it's not for uh kinder through five. And I'll tell you the reason why I'm asking the question is uh we might have several immigrant families that move move into a district that start from you know grade four three or four whatever the case may be and you know wherever they come from may not they may not not have had any uh any kind of you know evaluation about their uh dyslexia or any kind of reading uh difficulties. Do we u already have anything in that we do to you know try to understand whether that they have you know apart from this uh do we have anything this is

an additional um resource that's what I was asking we have plenty of other things that are already in place specifically to help support our English learners and folks that are coming in from other countries but this is specifically geared towards our like uh primary grades so that um we catch them when they're young right so if there's something that really stands out. Um, we can give those supports early on. And of course, we do have, you know, like I mentioned earlier, a student study teams and processes if students do come to us from other countries that are really lagging behind in their language skills. But once again, that language acquisition is usually five to seven years. And so we just have to be very cognizant of that fact because one of the big things we

don't want to do with this whole process is rush students to um be tested for special ed. This is kind of like that first layer of support that we can really you know key in on what are the identifying skills that the students are lacking so that those teachers can actually give them those supports. And so if we do that early on, then we would hopefully prevent some of our students being identified for special debt. Any more comments? Thank you, Dr. McCeri. All right. Could I have in Could I have um a motion, please, for approval? Move to approve. I'll second. It's been moved and seconded. All in favor say I. I. Oppose. Motion is approved. Let's continue to E bond program one blue arc electric change order number one for B for bid excuse

me B-13-2022-23 for the LED lighting replacement at Summerdale Elementary School and Morell Middle School. Uh superintendent, please. It is recommended the board approve the blue arc electric change order number one. This is for a slight increase of $3,957. All right. Any comments from the board? Surprising to see an increase when Tony is in charge. She's usually see credits, but we usually have. We will let us sign this time. So move to approve the change order. It's been moved and seconded. All in favor say I. I. Opposed. Right. Motion is approved. Let's continue down to two. Uh Tri Valley Excavating Company, Inc. change order number one for bid B-5-2024-25 for the site improvements at 1376 Piedmont Road. Superintendent, please. It is recommended the board approve the Tri Valley Excavating Company, Inc. change order number one. And

this is for what we're used to. A credit of $25,000. That sounds great to me. Any motion or comments from the board, please? Move to approve the change order. Second. It's been moved and seconded for approval. All in favor say I. Opposed. Motion is approved. 16. Do we have any requests for staff followup board? None. We shall continue to 17 items for f future agendas board. None. All right. Um could I have a motion please for adjournment? Move to adjourn. It's been moved and seconded to adjurnn. All in favor say I. I. Oppose. 5 to zero. It's been approved. Meeting is adjourned at 8:31 p.m. Good evening everyone. Are you
