belonging Aristotle who gave us much of our understanding of equality asserted that it is just to treat those who are situated similarly the same it would be unjust to treat those who are situated differently the same one stated this seems obvious yet we have difficulty acknowledging that we are differently situated even when we are most attuned to the fact that differences matter we're inclined to focus on a single factor which causes us to misunderstand the situation the debate over neutrality in relation to those differently situated has a particular history in jurisprudence um I will be reading from one of our core values um or the four core values are Integrity Excellence respect and accountability and under respect we have agreed we respect the views of others through an open exchange of ideas thank you trustee

are very excited what this could mean financially for our students as this is our biggest fundraiser of the year our summer program enrollments will open on Monday we are going to be offering our half day and full day summer adventure and enrichment programs at Javier Oaks Middle School and our Hobby and we will be at Carl Carlsbad High School for our summer Academy and finally I wanted to share an update on one of our programs our Science Olympiad program wrapped up over the weekend and I will read this because I don't want to miss anything but this past weekend over 150 cusd students competed in the Science Olympiad regional tournament at Miramar College we had 55 high school teams and 75 middle school teams competing collectively students practice weekly from October to March ending their

season by competing in a variety of science subjects and 14 students took home medals in nine different events I wanted to share two Javier Oaks middle and Sage Creek got second place in their respective events for the write it do it event thank you okay our next speaker is Mike Barella good evening those that engage in evil Deeds rarely if ever see them as such for the evil doer there is always sufficient justification to make the deed appear not only reasonable but absolutely necessary here again is the Paradox of human perfection the same mind that can comprehend the most profound philosophical and metaphysical truths can distort reality so that evil becomes good people who violate basic laws of humanity often are convinced that evil is about to be wrought upon them typically they rationalize their

behavior According to some principle acceptable to others in their society they have some degree of social or political support or institutionalized structure that helps make it possible to redefine the act and other than human terms that was written by uh Philip zimbardo in his book psychology and today complements milgram's work and I would suggest that the board read milgram's book obedience to Authority so that you know who you're serving okay you should not be serving the government you should be serving the people of this community you don't have to next speaker is Katrina and I don't want to pronounce your last name so foreign parent of current students resident of cusd and cusd teacher big WooHoo for passing the Dei success indicators last meeting so next step the town hall meetings what will you do

to make sure they are Equitable authentic and safe my husband and I both work full time and would appreciate knowing with enough timeliness the time date and location of these Town Halls ensuring that Working Families are provided opportunities to attend second please make sure Carlsbad families are prioritized how will you ensure Carlsbad voices are the focus lastly what will you do to make sure they are safe as a parent of young children I believe my children should have a voice but not be subjected to hateful rhetoric slurs or harassment please do all you can to get the Dei plan started in a safe Equitable and authentic manner for Carlsbad families thank you next speaker is Twin a last month I finally convinced my parents to get me out of a critical race Theory history class

at a nearby School District both of my moms are gay CRT taught me that America is bad Christianity is the basis of racist white male Patriarchs and people of color are the only ones discriminated against even though I've never experienced this myself my Asian mom was born and raised in a communist country and my American mom is white my grandmother suffered greatly during the cultural revolution my Asian mom is very familiar with censorship indoctrination erasing history and dividing kids from their parents my white mom was tolerant of CRT until my Asian mom compared striking similarities between CRT and what the communist government taught her in school if you want to create more hate innovation in America then teach CRT I never imagined I could dislike any class so much thank you twin B just like

my twin said she never disliked any class as much as critical race Theory and I see why comparing my homework assignments and tests to hers for the same history class was night and day well I was tested on the fall of the Roman Empire my twin was writing a paper on white supremacy well I was praised for getting an and the geography section my twin felt tears because her CRT teacher doesn't believe in grades we feel fortunate to be Americans but my twin CRT teacher said that Christopher Columbus was a murder rapist and a serial killer today in America you can be a winner or a victim no matter what your skin color is kids want to win not lose by being a victim of critical race Theory next speaker is Steve Morrell good evening

my name is Steve Merle I've been a resident of Carlsbad for 37 years my three kids are now in their 30s were raised successfully by the school district of Carlsbad I'd like to read the definition of bamboozle bamboozle thrown into state of confusion or bewilderment especially by being deliberately fooled or misled I believe the Dei program is a large bamboozle but the tide is turning a recent article in Washington Examiner diversity staffers seemed like a good idea in trump-style economy when business is booming that's when a company can afford it in a biden-style economy when you're worried about the future not so much the other problem with diversity staffers is that they don't build Market or sell anything what they do is create problems that then must be solved by the company not enough people

of color not enough lgdp Q people at the company these are the issues that the workers are paid to notice and Report we don't need these problems your boss is worried about meeting profit projections and payroll or rent thank you next speaker is Brandon T yeah good evening board members my name is brandonson I'm not a resident but when I'm work not working for the city I act as the president of the Carlsbad equality Coalition and I'd like to give my thanks and continuing to have dialogue about actual steps in regards to di but I've noticed that there are assumptions that these initiatives only benefit one side when all the net benefits are Norm punderson for evidence I have four studies I'd like to summarize a study by Stanford's University founded as brief intervention that

a forms students sense of belonging improve their academic performance one from Harvard University Harvard University reported higher levels of empathy perspective taking and social awareness whether from Columbia University acknowledge higher levels of Civic engagement among students even um especially compared to um sites that were more homogeneous and a study by UCLA found that students who experience positive cross-racial interactions um experience better academic self-confidence and my ask is to listen to feedback from the likes of World Cafe from the sources for those who may feel left up naturally congregated outside of digital space I also employ you all to give more weight to the voices of our students families and teachers who are harmed by current inequities across all identities instead of those who secretly enable such harms for the sake of their own Comfort thank

you so much our next speaker is uh Jake s hi my name is Jake savicki um I coach baseball at Carlsbad High School for the last seven years retired at the end of last season in 2022 the school the baseball program won an award for the district eight field of the year which is they divide the country into eight pieces and picked the best field so essentially top eight fields in the country and I just wanted to take I no longer coach there but when we received this award after I had left this will go into school and be there forever which is awesome I just wanted to thank a couple of the people publicly that really made this happen um the maintenance and the irrigation crew if you guys could stand up real quick

for me back here I want to thank you guys um just the behind the scenes guys that you don't see you don't know anything about it but when the curtain comes up and the product is there and the product is beautiful that's why Craig Jones real fast this is a extensive process he's the one that took care of it and lastly Ralph Cripe if you can please stand up this is a 50 years worth of legitimately building this field and it's his and it's beautiful and what he's given to the city [Applause] thank you our next speaker is krisha hi good evening crochet Walter I live here I have kids in the school district I'm I'm coming here today to talk about a letter that was posted on next door supposedly by a count city

council member that um was taken down a few days ago but again um this is what what Authority if this was actually written by a city council member did she have I'm appalled at what I read in the letter calling parents white supremacists that speak out against teaching any children Dei and more recently faes which only puts kids in buckets of oppressor or oppressed and classify them solely off the color of their skin which is by definition racism I will not tolerate being labeled as such and the purposeful use of this word is to incite violence and to intimidate people like parents grandparents and citizens to not stand up for their kids this hate speech should not be tolerated I feel that an investigation on where this letter originated from should be warranted thank you

next speaker is Scott Davison hi my name is Scott Davison and I live in the district why are we here tonight in this gym with all these people instead of back at our tiny district office with the usual crowd of the same four parents that show up to our meetings there are a lot of reasons really interference from a member of our city council and a politically motivated campaign of misinformation by a group claiming the board is pandering to white supremacists but it's also because of how this board and District are handling these issues we've had one controversial topic after another come up over the past several months and the response from this body is to be less transparent less provide less information and avoid opportunities to engage in discussions about these issues the controversial

curriculum being discussed tonight was initially going to be rushed through without discussion when other districts would form citizen committees and spend months discussing the subject your own surveys show that parents are losing confidence in our district whether it's academics mental health preparing students for college or even teaching basic critical thinking skills enrollment fell significantly and is now flat so I want to ask you tonight is this the way you want to continue do you want half of the community members to walk away unhappy with a rushed outcome or do you want half of them all of them to walk away feeling you've heard them do you understand the serious seriousness of these issues our next speaker is our Rachel Carlin hello my uh it is it has come to my attention that from my last

month's board meeting the focus that was plucked out was put fully on dress code let me be clear we did not as parents come to you over dress code we came to you with huge concerns about how Miss Flowers treats parents teachers and most importantly children it is about her leadership based on fear rather than on respect screaming at children so loud that teachers in surrounding classrooms have to shut their door it is about her screaming at a child demanding respect plucking a child out from a crowd and yelling at them about what they chose to wear embarrassing them in front of their peers denying children covering when it is raining because they choose not to wear a mask and then not allowing the work they have done to count staring parents in the eyes

and lying to them only to find out that that they know the truth call her out on it and then she backpedals and apologize threatens teachers of changing their schedules to a far less desirable one next year threatens teachers to be more mean to students this meeting is to inform you that Miss Flowers is a bully unpredictable a chameleon uses fear and intimidation to gain control loses control on a dime threatens belittles and overall does not treat thank you next speaker is Audra I feel like this needs to be moved up nobody can hear anybody it's weird just a weird spot to have it in anyway I use the name Audra I just feel like you guys need to tread lightly because as we're sitting here talking about all this racism you know like krisha

said it's either you're the oppressor or you're the oppressed and we have people sitting here calling people white supremacists who are trying to stop hate so I don't understand why they're pushing Hate by putting people in a box like that saying that they're being hateful for not wanting to spread hate with children because in teaching them not to hate you're actually teaching them to be hateful towards people and it's very terrifying because we're indoctrinating children into something that the next Generations that come forward are going to be totally brainwashed because they're going to either feel like they're oppressed or they're oppressing somebody else and it's totally bogus because that's not what we should be teaching children they should be learning things that have nothing to do with that instead of pushing it into their face

like this is something that they need to be dealing with and this is adult problems that we're bringing and putting upon the children and it's very dangerous where this leads so please think about that think about what you would want your children to learn and what you think our future is going to look like it thank you our next speaker is Mr JB Scranton may it please the board JB Scranton San Diego's number one sub I do not reside in the district Mr chairman I have in my possession right here the shack that you sent to me that you were ordered to pay by the Labor Commissioner the way I was raised is you're not supposed to use the courts as casinos the justice system is not something that you profit off of so I

thought the appropriate thing to do would be to endorse this over to the Ed Foundation but on further reflection I thought I would pay this to Children's legal services of San Diego not one penny of this is staying in Carlsbad and I think it's important that the Ed Foundation is present here to know what opportunities and resources are slipping through their fingers I'd like to invite members of the board executive leadership or anyone here in the meeting here tonight to make a matching gift to CLS it's a very worthy charity I'm also out of pocket no small amount of expenses but I'm going to eat it I'm going to wonder if you would consider whether you're going to stick the taxpayers with the cost of this litigation and how fair that is that is all

our next speaker is Tamara Dixon hi I'm Tamara and con car sorry culturally our educational system is teaching young people how to hate each other and how to hate our country the use of generalized suspicions based on race rather than evidence to a specific individual is called racism the political Theory race-based instruction known as critical race Theory where the ideology is to separate people into categories CRT is a divisive racist and against the law it is a Marxist ideology you know once we turn into a Marxist system it will take decades and decades to be able to get out of it you know how um how it has been for years for the Marxist regime most of these people don't want to be in a Marxist Society so this is the place that CRT is

taking us believe it or not hey thank you our final speaker is Jen belnap at President Biden's inauguration on January 20th 2021 Amanda Gorman became the youngest inaugural poet in U.S history in the recitation of her poem the hill we climb she spoke about Unity weeks before the inauguration the Insurrection on the capital shocked the world a months prior to that Americans watched cities across our nation burn with that backdrop Gorman penned these words even as we grieved we grew even as we hurt we hoped she said further not because we will never again know defeat but because we will never again sow division I sincerely hope that all of Carlsbad will choose to follow the example set by a young Amanda Gorman when she was just 22 years old Carl's Bad values culture we

celebrate that which makes us unique as individuals and also that which brings us together as Community after all there is always more that unites us than that which divides us thank you all speakers we now move on to part six discussion action items item 6.1 approval Carlsbad High School New course Film Academy ethnic studies trustees this is a discussion action item I will now turn over to Dr Churchill thank you sir so next slide please Dr and I uh for background at the September 14th 2022 board meeting the board approved a new course to be implemented at Carlsbad High School in the 23-24 school year called Film Academy English one at the February 15 2023 board meeting the board considered 13 new course descriptions for approval the board took action to approve 12 of those

courses two for implementation at Sage Creek High School and 10 for implementation at Carlsbad High School one of the approved courses was titled intro to film studies while the board did not approve the 13th proposed Court course that night Film Academy ethnic studies trustees gave direction to staff to make modifications and bring the course back for approval this evening tonight we've got a short presentation for the board first staff will provide an overview of the film Academy at Carlsbad High School an award-winning program that has achieved gold level certification by the linked Learning Alliance next staff will provide a brief overview of the state's ethnic studies model curriculum which was adopted by the State Board of Education on March 18 2021. finally staff will present information about the film Academy ethnic studies course including essential

learning outcomes and alignment with the state's framework in a future presentation we'll discuss the updated graduation requirement in the state of California that goes into effect with the graduating class of 2030. as you're aware students beginning with a class of 2030 will be required to take at least one semester of ethnic studies in order to graduate from high school in California and every District district will be required to offer an ethnic studies course to all students beginning in the 25-26 school year we have not yet begun the development of that specific ethnic studies course when it's developed we'll bring it to the board for approval we'll also bring back our graduation requirements for board approval between now and then with the addition of the ethnic studies requirement at the state level finally though it's not

displayed here on the screen I'd ask everyone to keep our graduate profile in mind as we wrestle with important topics like the one before us tonight I've received a fair amount of Correspondence on the topic and it's clear that not everyone is in agreement that said a Common Thread through many of the emails I've received includes a desire to provide opportunities for our students to develop important critical thinking skills our graduate profile promotes the idea of students as critical thinkers noting that graduates are inquisitive they notice they wonder they figure things out let's continue to find ways to stretch our thinking and our students thinking and continue to provide opportunities for students to think critically about the world around them through a variety of lenses and diverse viewpoints I believe the course before you is

one possible way to provide these opportunities not the only way but a good option for interested students and with that I'll hand it over to Dr Nye and Dr rocket a good evening president Pearson trustees and Dr Churchill the film Academy at Carlsbad High School as was mentioned before is a certified link learning program uh that highlights career Pathways and that's interdisciplinary meaning that it integrates subjects of History social science English and film currently students have the ability to enter the film Academy in both the 10th and 11th grade years the expansion of a film Academy freshman track would include Freshman Academy English one intro to film studies and Film Academy ethnic studies are would be an optional course of study as it's likely to include a class of around 30 students or so for

next year students who choose not to enroll in the freshman class will always have the opportunity to enroll in the sophomore year Film Academy as well as the junior year as they currently do now the next few slides just really highlight the current tracks for students in the film Academy with the second slide highlighting the new incoming freshman track for ninth grade so that's highlighted in purple at the very top as Dr Churchill had mentioned two courses have already been approved by the board and those were the film Academy English one which was approved in September earlier this year and the intro to film studies which was approved at the last board meeting in February as noted the state's ethnic studies model curriculum was adopted by the school board or by the CDE Board of

Education on March 18 2021 The Guiding values and principles for ethnic studies which is listed here and the key outcomes of ethnic studies on slide 11 were taken directly from that a doc from that document and approved by the state board two years ago so you have before you tonight exhibit a of the board report in general the course outline of the film Academy ethnic studies course you'll notice two columns that exist the column to the right is language that was taken from the California model curriculum and its purpose is to show some general alignment to the film Academy ethnic studies course the column to the left labeled content goal and essential questions will be the anchor of the work that's used to create the student discussion the student collaboration and provide the framework for

the lessons and and activities for this course based on the conversation at the board meeting District staff at the last board meeting District staff work with teachers from the film Academy to refine and further clarify the content goals and essential questions in that left-hand column staff Incorporated the suggestions made by trustees at the last board meeting regarding the Fine Art ethnic study or the the film Academy ethnic studies course we believe that those suggestions further clarify the purpose of the course along with a dialogue and discussions that students will be having staff work directly with the teachers from the film Academy to incorporate those suggestions of which the teachers were on board with the modified language the course description and outline that you see before you this evening reflects that work the next slide describes

the six units of study that will make up the course and the next slide shows the essential learning outcomes and content goals and how those align with the key principles in the model curriculum that was provided by the state again along the left hand side are the anchors of what the course will be about the right hand side just shows alignment to the model curriculum from the state as we mentioned before excuse me as we mentioned before uh apologize as we mentioned before next steps would be pending board approval um this would include getting student interest through course selection process which is currently ongoing so we want to make sure that there's a course selection process there as well as ensuring that there's enough interest from incoming freshmen and students to add it to the

CHS master schedule and then the film teachers with the support of the instructional Services team would then build out specific lesson plans and scope and sequencing for the course that is in alignment with each content goals and essential questions which is listed in exhibit a so that concludes our presentation and we're happy to turn it back to you president Pearson thank you Dr Nye thank you Dr Churchill trustee this is a discussion action item just a reminder this is time for public comment we have 18 blue cards gives each speaker one minute in order to allow speaker to present their comments and ensure we are able to properly attend the business of the board per board by law 9323 public comments are limited to 20 minutes as I said that that leaves each speaker with

one minute when I call your name please come to the podium state your name and indicate whether or not you live within the boundaries of the school district school district we'll have the timer on the screen and your mic will be muted when your time is expired the first speaker is Mike Barillo I handed out a letter that uh that was sent out now I don't know if that's really uh Dr Patel or not I'm going to give her the benefit of the doubt and uh ever come forward and either claim it or not but uh if it's not her if it's somebody that spoofed that email there's a California Penal Code part one title 13 chapter 8 treats cyber impersonation a public offense punishable by a fine up to a thousand dollars in imprisonment

and County Jail up to a year or both so it really should be I don't know if the police are here but you might want to take some notes and look into that please thank you so another uh word of advice from Shelby Steele Stanford professor white guilt is the terror of being seen as a racist it's an anxiety in White America a vulnerability of being disarmed of moral Authority by being called a racist if you learn that you're good to go thank you our next speaker um excuse me if I pronounce your first name incorrectly la litha n it's natural hello my name is lalitha and I reside within cusd I am the mother of two children who attend cusd schools I'm also the ethnic studies librarian at Cal State San Marcos I'm here

to voice my support for the approval of the ethnic film studies class at Carlsbad High School students of color account for nearly 80 percent of the K-12 population in California given our increasing diversity it is vital that our curriculum reflects information about the vast ethnic and racial groups in California and the nation as a whole the field of ethnic studies is about fostering connection and developing cultural competencies that enable us to interact and form meaningful relationships with people across different backgrounds this is an important life skill for our children to learn as they prepare to enter a diverse college and work environments but at its heart the field of ethnic studies allows for the inclusion of perspectives that have historically been improperly acknowledged or never even reflected in the curriculum therefore I urge cusd to

approve the ethnic studies Cricket film studies curriculum it's about creating a welcome our next speaker is chiwoo thank you my name is chi Wu Chen good to see you everybody I will urge you to vote Yes on item 6.1 that's my key Point um actually the course will help our students interact and work better with other of different ethnic and speaking to the mind so people can hear you okay sorry thank you do I got more time um so we can help students better prepare once they enter the workforce on the other hand not approving the course will put them put our students at a great disadvantage when they trying to find a job most companies tend to hire diverse group people with different background python is example their success reason of success is because

they have diverse background because I know I've been there for 20 years our next speaker is about your names is l-a-n-i-e-c-e not here okay next speaker is Kevin clauger hello um I have a son who's in second grade at Magnolia Elementary and I grew up uh I'm a resident of of Carlsbad and um I graduated uh Carlsbad High School in 2004 and took film studies there for two years and then I graduated USC School of cinematic Arts with a degree in film I'm currently a professional film editor editing documentaries I've edited two films that have won Academy Awards and I am here in full support of this program of this class this Pro this class reminds me of the kind of class that I took when I was a student at USC but it is

dumbed down to be a college prep class for high school students that's exactly what I see this as I read the curriculum I was kind of shocked that people were so up in arms about this class honestly it's the kind of course that I wish I could have taken when I was a student at Carlsbad High School that's my statement thank you our next speaker is Katrina hello Katrina weilik cusd parent of current students resident of cusd and cusd teacher the ethnic studies course I am in full support of this course has been developed by highly decorated and Veteran Educators responsible for developing an award-winning Film Academy recognized as a gold certified link learning course the film Academy ethnic studies course is clearly aligned with the guiding principles of California Department of education's ethnic studies

model curriculum and should be passed today some in the community want you to consider adopting a curriculum from the alliance for constructive ethnic studies as a professional curriculum writer who worked outside of the district with non-profits such as understood College Board Oak foundation and the ACT Center for equity and learning I can say without a doubt that that curriculum is lacking in education research alignment to CDE model curriculum core standards and will serve to further divide and misinform our community please pass our curriculum today thank you our next speaker is Kevin clauber okay our next speaker is uh Augustine I think it's Augustine Dao Augustine down Augusta Dao okay thank you yeah my name is Augustine I reside in trustee Williamson's District I hope the changes in the verbiage is to your liking and I

hope this course isn't about to get brutally watered down because we need to give these kids the comprehensive history they deserve trustee Pearson last meeting you mentioned that white people had also gone through slavery too and the conversation shouldn't focus on eurocentrism in AP US History we are we've already been told at length how colonists were went into indentured servitude but if you wanted to Center the conversation more on white people you'd at least understand that indentured servitude wasn't about ethnicity it was about socioeconomic status so if you want to contribute if you want to critique capitalism and labor exploitation that's a whole different conversation that I'm willing to hear you out on but a few of these people might call you Marxist for it it is wrong to imply that throughout history a subgroup

of white people in the U.S has faced anything parallel to the continued systemic discrimination imposed on people of color if you have an issue with focusing on the dominant eurocentric culture I implore you to find a point in film history where the dominant culture was not eurocentric thank you our next speaker is Stephanie Wells hi my name is Stephanie Wells and I have two students in the district I'm here tonight in support of this agenda item I'd like to acknowledge the hard work our Educators put into developing this course I honestly can't even believe we're here especially after hearing the same people in this room scream let them learn and let them choose for the last three years this is an optional course by not approving this course you're removing the choice to learn for

our children while this course is optional I am looking forward to it being a requirement for all students as a mother raising biracial children in this community this education is necessary people in this community believe ethnic studies is based on theories not facts my mother-in-law was born in 1945 and I promise you her lived experience is not Theory and systematic racism still exists today we have students in this community using hate speech and we need them to do better with this course next speaker is Jen hemberger hi everybody I'm Jen hemberger and I live in Carlsbad I've got two boys I've got one at Valley Middle School and one at Carlsbad High School thank you so much to the board and to the staff on all of your hard work for all of the work

on Dei and this ethics ethnic studies class I am asking the board please please please allow the students the option to take this class next year again I'm going to say it it's an optional class meaning if you do not want your child to take this class please don't elect it but please do not take away other students choice to take this class if they wish there's lots of talk in this room about how this class will create Division and hate well I'm going to just go out on a limb and say that none of you people who are saying that have a child in a marginalized group we've got a lot of hateful things being said on campus every day and it needs to stop and they need to be educated we desperately need

this education next speaker is krisha hi I'm krisha and I live in the district I urge you guys to please vote no on this Film Academy ethic studies it is riddled with critical race principles throughout the curriculum words like white supremacy racism and other forms of power and oppression and racist bigotry discriminatory imperialist and colored beliefs our Colonial beliefs and practices instead of teaching division divisive curriculum why not teach American values like Liberty we are more alike than we are different we all want for our kids the best education ability for them to express themselves freely be accepted for their uniqueness and have the best opportunities for a successful future teaching children one is inherently oppressing while the other is inherently oppressed what does that achieve but give Liberty to one group of people at

the expense of the other group I just wanted to say that I'm confused is either optional right now and then will be required because somebody said it would I'm looking for our next speaker is Paige hi I'm Paige desino our schools strive to prepare our students academically for Life Beyond Carlsbad having taught at Carlsbad High School for more than 20 years I know we have a rather insulated culture this class expands our students experience Beyond City borders and allows students to become more empathetic toward others no one needs a class to be aware of the lack of bipart individuals as actors directors and supporting staff in the film industry over the last century it's obvious if you've followed films at all learning about how that happened and what can be and is being done to

rectify that inequity seems like a plus to me do we want to continue discriminating against others because of their ethnicity or do we want to understand history and move forward for a better future for all we shouldn't be afraid to address past inequities even if we are uncomfortable with that information education researchers thank you next speaker is Scott Davison our legislature added ethnic studies to teach quote Untold positive stories unquote about different cultures that have made contributions to America if you look at the model curriculum's eight outcomes for ethnic studies you'll find things like working toward greater inclusivity and supporting a Community Focus does teaching quote how Hollywood used African-American stereotypes to push the dominant culture in America accomplish any of these outcomes or does it further a far left political theory that America was

founded on racist principles and that all institutions whether education law enforcement or Hollywood are irreparably corrupted by institutional racism and can only be salvaged by dismantling them does this curriculum comply with our board policy that controversial topics quote represent facts and concepts of controversial issues from multiple perspectives to ensure that students develop critical thinking and problem-solving skills I challenge you to find the other perspective in this curriculum this course tells students how to analyze Empire is related to white supremacy does this thank you Scott next speaker is Cynthia Michael hi I'm Cynthia Michael I have a junior at stage Creek a freshman at Carlsbad High and a fourth grader at Hope many of you already know me um I appreciate the fact that you guys voted in Dei um as a member of a minority

group and having children sorry I'm short um having children of a minority group I really appreciate it my only issue is the implementation of it as you guys know the California curriculum had two different drafts and they both included anti-israel in the in the agenda I'm glad to see that not the agenda here our next speaker is Audra I use the name Audra so this is very dangerous because you're saying that it's critical thinking when in fact it is not critical thinking because you're not saying what do you think in leaving it open-ended you're giving them options a b c d which one is it so you've got to pick a box just like are you Republican or Democrat are you gay are you straight we have to pick a box in order to go

along to get along because this does not it's not positive and it does not teach empathy it teaches straight up hate and that I what I don't understand is you want to talk about inclusivity and and being diverse why don't you include white history in that why not you want to be how is that not Equitable because you want to teach this this this then you should teach it all and the fact that you want to use Hollywood when they use predictive programming in their movies to teach history is very dangerous because Hollywood is totally bogus and not something that we should look to for history and the fact that you thank you Audra next speaker is Gene Walker hi my name is Gene Walker I'm a Carlsbad resident I have two children one of

whom attends school in Carlsbad I'm a little bit concerned about this item because I think that the curriculum as I saw it first of all it's going to be required for kids on this Film Track in ninth grade and I think that it's um the curriculum is a little Advanced for a ninth grader to understand I also hope that there's going to be a lot of discussion where different points of view are really considered in the classroom and that the teachers allow that back and forth I'm really concerned though about what brought a lot of people here tonight which was a plea from a city council member referring to white supremacist extremists and Boogeyman who brought people to the school board to influence you I absolutely do not believe that anyone in this audience is

a white supremacist and extremist or a thank you our next speaker is Vanessa foresight I think last name's foresight thank you I reside in Carlsbad my students don't go to the school district my children don't go to this school district but I am very concerned about what's being discussed here and what's not happening to benefit all our children in schools uh you know I when I was a young person I stayed with my Nani and I watched a lot of old movies The Late Show The Late Late Show she let me stay up late and I can tell you that in films there was a lot of stereotypes there was um you know predominantly white people who were the actors in the industry and that there was even people who were made to wear black

face there were people who were Asians who and from Latin America who had to disguise who they were to be able to even get roles so I really think we can do better there is some movement in the house thank you to be hopefully I'll pronounce the first name correctly ajahan turker um so I I don't have a speech I'm just here to voice my support for this class when I was in high school I would have killed for a class like this I grew up in a place very similar to the the demographics of this town my kids are in elementary school I am a resident of Carlsbad and if they were in high school this would not be optional for them they'd be taking this class and we'd be talking about the movies

and the things that they were seeing none of this happens in a vacuum none of it we watch movies with our kids all the time probably inappropriate movies but we talk about it we talk about what they see we talk about what scares them we talk about what makes them happy it's not just the teacher's job to show them a film in a vacuum and then have no discussion about it that that discussion that critical thinking that you were talking about is going to happen do we really think a room full of teenagers are going to watch a controversial movie and not have anything to say about it like to each other to their friends uh you know when they run home and watch YouTube videos about about it come on we all our last

speaker is Rob Howard [Music] president Pearson the board I'm I'm going to try to be quick because I know we only have a minute and I didn't have a lot of I had not planned to speak on this but I'm listening to what people are saying you all may not be able to tell but I'm a black man in America and so I want you to take some a little bit of time to think about this while other people are speaking to why not to have this I can tell you as someone who grew up in a white school district in the South who got nothing associated with who I was as a person and the values the positive values that I could bring to the table when everything and all the things I was

being taught were negative what happens is you create an environment and you you deal with with kids in a negative way I volunteer for students in this District that are struggling and they want this type of thing this is just one piece of how to let them know they can be okay and so what I am saying is God didn't give us a spirit of fear but Power love and a sound mind let's work together I support this program okay we are we have finished our public comments staff do you have anything to add no not at this time trustees do you have any questions Mr Rawlings thank you um Dr Nye Could you um uh confirm the um that this course would not be a prerequisite for any of the other Film Academy courses

within the pathway that is correct students inner Pathways in the film Academy either at the ninth grade year the 10th grade year or the 11th grade year they would still have the ability to enter in in the 10th or the 11th grade year if they chose not to participate in the ninth grade year thank you trustee Williamson thank you thank you um Dr Nye I've heard from many community members who are very concerned about the focus of this class they've expressed a concern that rather than working toward greater inclusivity and supporting the Community Focus this class would be just the opposite so there's no misunderstanding would you please answer the following question will this class be based on criticizing America using themes of dominant culture who that was created by Empires and based on white

supremacy who oppressed non-fight cultures the best way I know I would say that the design of the units of study are built around a cycle that examines stereotypes in film the appropriation of cultural representation in film efforts to overcome those circumstances new voices that have emerged in film as a result of those efforts and the recognition of the progress among ethnic groups in Hollywood and in film I would go on to say that students will be asked to examine and draw their own conclusions as it relates to historical events through the lens of film you know we do have board policy specifically around controversial issues that was cited before board policy 6144 and it talks about instruction being presented in a balanced manner addressing all sides of the issue without bias or Prejudice and without

promoting any particular point of view it also goes on to say that adequate factual information shall be provided to help students objectively analyze and evaluate the issue and draw upon their own conclusions did Dr Churchill's point you know we are when we walk into classrooms what we want to see teachers encouraging are those critical thinking skills and we walk into classrooms all the time and we see that every day with our teachers they're encouraging students to formulate their own opinions to come up with their own ideas they're presented with factual information and then asked to theorize about that information so the answer to your question would be no the key themes that are in the film Academy are along the aligned along that left-hand side that I mentioned before in exhibit a and and I

wholeheartedly believe that that will be taught in this in this course thank you Mr Rawlings thank you um Dr Churchill Could you um repeat what you had talked about as far as this is an optional course that would be offered and that there is not a requirement um and the only requirement that you talked about would be um in a few potentially in a few years under the state of California that's correct the requirement in the state of California will be for the graduating class of 2030. to have taken one semester of an ethnic studies course prior to graduation so districts are obligated to offer such a course by the 25-26 school year so three school years from now every District in California is to have an ethnic studies course that counts towards that graduation

requirement So currently we haven't even brought the grad requirement to the board for updating so in ethnic studies graduation requirement doesn't yet exist here in Carlsbad because you haven't updated the policy as such the ethnic studies Film Academy of course that we're discussing isn't required nor does it need a graduation requirement Mr Rawlings um to follow up so just to be clear that this course if adopted tonight would impact 30 to 35 students per year total correct yeah likely I think Dr and I are Dr Brock speak to it but I I imagine if they build a section next year which is what I believe we're anticipating that's 30-ish students who would be enrolled in that course next year Christopher Beth are we required under Education Code 60002 to promote the involvement of parents and

other members of the community in the selection of instructional materials and if so have we done this with this curriculum yeah you're not approving instructional materials tonight you're approving a course description so we will adhere to all education codes including Education Code 60002 thank you I have a question for you Dr Nye just to be clear if a student wants to be in the film Academy do they have to take the ethnic studies course or can they still be in the academy so if they want to enter the academy in the ninth grade year it will be part of that ninth grade curriculum but they also have the opportunity to enter the film Academy in the 10th grade year and in the 11th grade year so that's the answer to the question so if I

understand that they would have to take it in the ninth grade year but they could enter in the 10th or 11th grade and not have to take that course that is correct okay trustee Rawlings as a follow-up to that um currently we don't have any options in the film Academy in ninth grade is that correct that is correct so this would be an additional option available for those students interested in being in the film Academy in the ninth grade yes that is correct trustee verbat we've heard a lot of complaints from parents and community members that this curriculum includes critical race Theory and I was told staff and the board and parents have previously stated that CRT is not being taught in cusd according to California School Board Association cesba a core principal of CRT

is that race was integral to the development of American systems and institutions like law government politics religion and the economy and therefore those institutions whether by accident or design retain aspects of racial preferences that influence their development so when our curriculum talks about systemic racism in 9.1.5 are we not talking about CRT again I believe you're referring to the exhibit if you look at the exhibit along the left that's what's going to be taught in our course if you look at the exhibit on the right that's the alignment to the model framework we're not using those terms systemic racism in the course that we're teaching and we're showing how it aligns Loosely to what we'd be teaching along the left hand side so hope that answers your question it answers my question I'm just wondering

then why it's in here I think it's causing confusion again we tried to clarify that um the the only reason why it's in here is to show some alignment to the model curriculum uh we we try to somewhat align all of our courses to uh standards from the state of California and so that's the purpose of the alignment here today but just to be clear again the course itself is in the left-hand column and it talks about content goals and essential questions that will be the focus of the course the questions trustees trustee for bath sorry 9.1.5 specifically mentions envisioning a post-systemic racism Society so again you're saying that's that's not going to be taught in this curriculum because it's on the right hand side is that correct what's being taught is on the left

hand side what influence does the film industry have on racism in the late 20th century that's the essential question that's what will be built around the curriculum if the course description is approved and uh yes that's what we'll be taught doctor and I just had a question on timing if the board approves the class tonight what is the timing on the to developing the local curriculum with the community and all stakeholders you know we'll have to work with the instructional Services Department the film Academy teachers and then we'll develop some kind of timeline as as it relates to adhering to that Education Code about promoting the curriculum but we haven't fleshed that out yet as far as the timeline other than the fact that we would adhere to that Education Code and now as I

looked at the ethnic studies model curriculum that was a major part was developing the curriculum with the community so I just wanted to see what the intention was yeah and and to the extent of the required course that Dr Churchill had mentioned as well I would imagine that that would be a major undertaking with the local community in the development of the required course for all students to take doesn't preclude us to doing some promotional in regards to this course but I would imagine it's going to be much more extensive for that required semester-long course in ethnic studies any other questions from trustees trustee Rawlings is now an appropriate time to ask a question of a trustee or would that be appropriate and discussion I think that would come after the motion if there's a

motion in discussion correct let me get up thank you Dr Churchill so right now I could ask a question no no until there's a motion in a second okay trustees uh seeing there's no other questions may have a motion to approve the course description of CHS Film Academy ethnic studies exhibit a so moved Williamson second Rawlings okay now it's for discussion and I think I also believe to answer your question trustee rolling stance ask any questions of the trustee any other trustee as well thank you um trustee or Beth um I've heard you mentioned CRT several times and I'm trying to get a working understanding of what that means so could you give me a definition of CRT I have csba's critical race Theory frequently Asked question um so I'm trying to seek for understanding

from you as my colleague because I realize we're going to be talking about this quite a bit it sounds like and so I'd really like to find from your perspective what your working definition of CRT and then how that connects to what you're seeing in the current curriculum well I believe that CRT is divisive and that I'm asking for a definition not a not an ammunition I wasn't prepared for a definition for you but okay because that's what I'm asking for is a definition of what you're saying so I can have a clear understanding of how to to you know to understand what you're saying about this particular curriculum because that would help me to understand so I can know how to vote so you don't have a definition well I don't have a definition

prepared for you right now okay and then so from what you're saying with the CRT that you're mentioning how how do you believe it applies to this particular curriculum when we're if there's not a definition that you could apply it to I believe what I was saying is that we have parents in the community who are concerned that CRT is in these guidelines here that have been on the right hand side okay like Empire building and white supremacy and racism Empire building things like that and so they saw this and they have questions about it when it's next to what Dr Nye has presented to us and so I think there's been some confusion because Carlsbad has said that we're not teaching CRT and so when they see The Guiding values and principles here they

seem to be more aligned with CRT but that's what they're saying what is the RT is are you saying CRT is nation is that's what I'm saying what is it I don't know what it is and so you're saying this applies here and then yeah I don't feel like I have got an answer but okay thank you but you that was the response there was uh trustee Williamson thank you I appreciate the opportunity that I've had to meet with several of you in so I did not share my cold with all of you that's why I'm kind of isolated I'm I'm in any way but I I do appreciate the opportunity um um we're lucky to live in this community I believe that we have people who feel passionately about the children and we are

lucky that they do because there are communities that don't and even though there is not unanimity amongst our community I would rather have lots of passionate conversation than no conversation and having and having apathy so I truly appreciate what we have here um I'm always interested in Lessons Learned as most of you know and as I have looked through this process and thought what what Lessons Learned come to mind one that kind of stands out to me is I believe that when we have a controversial topic having conversation is a good thing and welcoming voices is a good thing and doing as much pre-work as possible is a good thing so if there is consensus of two other board members I would like to direct staff to it sometime in the future uh have an

agenda item where we could propose having a curriculum a community or something about curriculum advisory committee on this topic before the next course which will be mandated yes okay which would be mandated in a couple of years in others to have it have it come back as an agenda item and we could have a discussion about if that's something that we want to pursue and if so to discuss the makeup of it so that's and we can you can ask for thumbs for that in just a second um so I'll just including concluding my remarks as long as the curriculum for this class is based on the content goal essential questions which were on the left side of attachment a I will be strongly voting to approve it and I predict it will be in

great demand next fall I look forward to sitting in on a couple of the classes in fact I think it could be a a Growing Experience for me and I and I appreciate the the work that staff has done so I will be voting yes and but I would like to see if there is um Mr Pearson if there is consensus to him I'm going to just make sure that this is the appropriate time for that so can you restate what you you're looking for three thumbs yes and I did look and I did tell Dr Churchill that yes that to have an agenda item come back at a future meeting to discuss having an advisory curriculum committee to discuss the the um when the next ethnic studies course is going to be before it

is developed to have that be a advisory only not a decision-making body okay um so okay I'm saying five thumbs okay okay and thank you trustee Williamson for that I like to make it just just a comment um I will be supporting this with the notion that the community the full community has a voice in the curriculum and what I mean by that is I've looked at every email that came in even though I didn't respond and I saw two sides of the community and I think the best work is when we have the full community all of Carlsbad talking about this curriculum and so my My Hope Is that as as in the ethnic studies model curriculum it says to have the full community involved along with the teachers and I'm not taking the

teachers out of this by the way that but the stakeholders are included in that I think that's a key piece so I will be supporting I will be supporting the motion with the notion that our community is fully engaged in the curriculum building trustee Rawlings thank you and in the last meeting I did vote on no on moving this to staff and I wanted to explain that that vote and the reason I did that is is because in our um in our governance handbook under section c it says I understand the distinctions between board and staff roles and refrain from performing management functions that are the responsibility of the superintendent and staff and um I still I do not believe in the principle that we should be directing staff to to write in uh into

syllabuses of what our desires may be what our opinions are I think we have an obligation to um to trust in our staff trust in the professionals that we hire to create these curriculums based on factual information from the California Department of Education so that's from my perspective that's why I voted no because I think to me the principle is um is that important however um from based on what Dr Nye has stated that teachers were consulted teachers this was discussed with our professionals with our instructional staff and they were able to meet the requests from this board in order to vote in favor of this curriculum or I'm sorry of this course that they were able to find ways to still maintain the Integrity of the course that they will be teaching every day

I would also like to state that so I will be voting in favor this time because I do believe that this course is important also within that same section of our of our handbook it also talks about keep learning and achievement for all students as the primary focus when we say all students that means those 35 students that will want to take this course that includes those students that want to pursue a film career like we heard the speaker earlier because the a film career I can't think of a more um I can't think of a career that you would need this class more than film and so and we heard about how Hollywood is the way it is well you're going to need this course in order to get a job and film um

so I I do believe that that's really important and lastly I'd also like to say that we um that we have within our within our roles as well um for the board that um that we involve parents students and staff and developing a common vision for the district focused on learning and achievement and responsive to the needs of all students so those 35 students or those 30 to 35 students are part of that all and so for us to deny those students and those parents that want to take this class is not consistent with our governance handbook so I will be voting yes I just want to also say I did mention that this is a course selection sheet from one of our high schools and it has eight sections for parent initials as well

as a parent signature so a student cannot take a course in our schools without having knowledge and having and providing approval to their student so I do believe that that I think there's enough safeguards here to ensure that the students that want to take this class can take it and the students that don't want to take it are not forced to take it at this time thank you sorry we're building favor Miss Garcia please call for a vote oh was there I'm sorry trustee Ward yes I just wanted to say that as a Japanese American woman I'm really excited about this course and I too am going to be voting yes on this I appreciate all the comments that we have received from uh our Carlsbad community and I appreciate this dialogue that we're having

I think this is important and this is exactly what's going to be happening here with this course and giving these students an opportunity to hear and see and then have that critical thinking opportunity and dialogue with all of their classmates I'm really excited for that opportunity for the students so I just wanted to just add that on and say how proud I am that we're moving forward with this any other accounts before we move to a vote I'd like to make a comment please trustee verbat well I just want to say that I agree with with trustee Pearson that we need to go to our community and we need to hear from them as we move forward I think that's very important I think there was some confusion here with um The Guiding values and

principles being listed here and so I think that led to some of the feedback that we did receive from people in our community and I think it's important that we're listening to both sides of this it's very important and I um and I think that Oceanside I believe has a committee I think San Diego unified also has a committee a city citizen advisory committee that's looking at ethnic studies and I'd like us to consider inquiring about those and um seeing what's what they entail who who's on those committees and and develop a committee for ourselves here as we move forward because we need to listen to our stakeholders thank you trustee Beth any other comments before I turn my head to the right okay [Laughter] Miss Garcia for a vote trustee Williamson yes trustee Ward

yes trustee verbeth yes trustee Rawlings yes trustee Pearson yes and I just last comment is thank you to all the community all the community for coming out especially at Carlsbad community and I coming out to uh make your comments and thank you Trustees for the engagement with each other as well too we now move on to item 6.2 annual measure HH financial and performance audit fiscal year 2021-22. I didn't think so okay trustees this is a discussion action item I'll now turn it over to Mr Eric Dill thank you president Pearson and let me adjust the mic so I'm not could I request that we take a pause for a moment while folks are readjusting do uh trustees do you want to take take a break for five minutes sure her sweet okay as well

we are back um item 6.2 annual measure HH financial performance audit fiscal year 2021 22. trustees this is a discussion action item I will not turn over again to Mr Eric dilba thank you once again president Pearson uh and members of the Board of Trustees as the board's aware when measure HH was passed in 2018 it was done so under the rules of Proposition 39 which not only requires an independent citizens oversight committee but also requires annually that audits are performed specifically on those bond funds both financially and on the performance of those Audits and every year in March we bring you the results of that audit for the prior fiscal year when the audit report was complete director arcelli Salazar and I met with members of the ioc audit subcommittee and also the board

subcommittee of trustee Rawlings and and trustee Williamson and also Mr Greg Dowell they will discuss the results of that audit tonight and following that we ask that the board respectfully accept that audit so Mr Dell good evening superintendent Churchill District staff trustees and citizens of Carlsbad hey let's talk about something controversial like Bond spending okay I'm Greg Dowell and I'm a resident of Carlsbad for 27 years I have two children that were shaped by a great education here in Carlsbad schools and I'm also the chairperson of the independent oversight committee which along with J Dr J Marquan Shauna Hurst Brenda Hall Sam Ward Michael sabeda and Marla Evans it's our role to ensure that facilities spending aligns with voter approved purposes and annually the district performs an audit of facilities spending and it's spending against

measure HH which is the 265 million dollar bond that was passed by voters in 2018. this year's independent financial and performance audit was conducted by the San Diego accounting firm of Christy white which serves K through 12 schools in charter schools throughout the states um the audit covers the year that ended on June 30th of 2022 and as Eric said last Thursday I met with the accountants District staff and several members of the board to review the audit results in a word the audit results were outstanding allow me to give you some highlights with regard to facility facilities project expenditures the accountants tested 12.4 million dollars worth of non-personnel expenditures or 68 of the total budget from HH that was being tested for validity allowability and accuracy They concluded that the sampled expenditures were totally

in compliance with the terms of measure HH ballot language the district approved facilities plan and applicable state laws and regulations additionally all Personnel costs charge to measure HH were consistent with the bond building fund allowance the district properly reviewed projects and they applied appropriate procedures for contract bidding and change orders were properly approved and in accordance with District policies in short the district received a clean audit with regard to measure HH spending in the words of the independent accountant carlsbad's clean and unmodified rating is the absolute best We wish all districts showed the same fiscal and performance Excellence so allow me to extend a warm congratulations to the trustees and to our District staff for managing our very precious educational Monies consistent with our electorates wishes good job if you have any questions I'll be

glad to handle them now I like that thank you very much thank you public comment we have not received any blue cards for this item trustees do you have any questions okay may I have a motion to accept the measure HH Auto report for fiscal year 21 22 as presented so moved Williamson second rolling trustee Williams made the motion trusting Rawling second the motion any discussion Christy Rawlings I felt bad that the board members that are on the subcommittee were the ones that motioned in second but I just want to thank uh Greg and the committee fantastic work fantastic job and we're fortunate to have you and the committee to provide such a wonderful presentation and to make our audits entertaining so thank you very much appreciate it are there any other discussion great Mr

C please call for a vote trustee Williamson yes trustee Ward yes trustee for Beth yes trustee Rawlings yes trustee Pearson yes motion passes five to zero okay thank you thank you thank you we now move on to item 6.3 second interim budget report for the period ending January 31st 2023. trustees this is a discussion action item I'll now turn over to Mr Eric Dill thank you again and I often refer to the audit reports as the fiscal director's report card uh she is with me she's behind me tonight uh aracely Salazar um and so that the audits are are always um a credit to her work and the work of her Department uh and also Ms Kimbrell so both of them have a hand in the measure HH audit but uh Miss Salazar is here

tonight um uh in support of me as I walk you through the changes uh in the second interim budget report I know the board has had a chance to see the uh attachment the the presentation prior to the meeting on the board agenda so I'll walk you through the highlights of changes that we've had since the first interim report which was in December and these this is our budget as of uh January 31st so themes as always we have a positive certification for our budget which means we're able to meet our financial obligations in the current year and the two subs fiscal years as we do every year at this time we update all of our current and our multi-year assumptions we know a little bit more on in the out years with um uh

with the governor's proposal we did make some changes to the current year budget based off of some of the information in the governor's proposal which I'll walk you through we adjust our expenditures and as I say we are projecting budget stability uh as far out as we can see so the high level summary of the general fund is here and it's broken out by unrestricted and restricted and then the combined general fund as you'll see we still have a modest Surplus in the unrestricted general fund we still are showing of course the the Surplus in the restricted there was a major change to revenue which I'll walk you through in a moment but but on both sides we're still showing a surplus at the end of the year for an increase in the ending balance

uh to just break it apart and uh so you can see where we were in uh the first interim budget and then the second inner budget so it really matches column to column to column you can see the changes overall are you cannot see anything uh because one moment please I have to stop casting I promise you this worked the first time I did this I know well because it kicked me off and I had to do it again and I forgot to show all sources okay now you can see it's a good thing you read this before the meeting so the on on slide number four um shows the the side by side where we were in December where we're showing where we are here in March and as you can see the changes

are not that great and mostly driven by Revenue but also some expenditures which I'll now walk us through the bar chart which I always show uh showing our history and we have a very good history of dollars in roughly equaling dollars out this year we're showing of course more Revenue than expenditures and that's primarily due to revenue on the restricted side so we had two very large one-time restricted block grants both the Arts materials and instructional materials block grant and the learning recovery Grant we took those dollars and this year we'll be spending them over multiple years so when we get a little bit later in the presentation you'll see how the expenditures rise in the following years when we actually spend the dollars but this year we're showing that where we received them those

highlights on Revenue our major source of lcff in property tax those are just some minor adjustments you see that big red minus 2.4 million dollars this reflects the governor's proposed mid-year cut to the Arts and materials discretionary block grant now while that requires the legislature to concur with that proposal we thought that the most cautious thing to do would be to back that Revenue out and if the proposal doesn't go through we'll put it back in but at this point uh you know we want to make sure that we're not counting on Revenue that might not materialize by the end of this fiscal year so with that big um with that that big mid-year cut there we thought this was the right thing to do fortunately that block grant is on the restricted side and

we had no plans to spend all of it this year it was really spending in the second and third year of that Grant so this doesn't affect our ability to use any of those dollars this year it's just playing out through our multi-year projection indicating we might not have these dollars next year or the following year and you know we're we're crossing our fingers that that cut doesn't go through and if it doesn't we'll just uh have an increase in the restricted ending balance for the purpose of buying instructional materials which was part of the plan that the board adopted at the last meeting so these are the words uh that I just said on the following on the previous slide and then just showing the um the makeup of the revenue components how they

have uh changed over the last few years on the expenditure side uh the certificated salaries really is a increase in donations so receiving some additional funds which were tied to extra hourly salaries for certificated folks so that gets plugged in as we recognize those donations classified salaries we can okay that's not my fault but I will have to go and do it all over again and I pretend that was the problem the first time all right let's see okay oh it just popped back up for me nope it didn't I do not have it yeah okay hang on yeah it's not showing up for me very bottomless possibly very bottom I'm at the very bottom yeah go ahead and just refresh the list like a battle three dots again back to cast okay thank you

Dr Churchill okay I was on slide nine okay like how I kept the same face the whole time as if uh the Youtube stream had just Frozen um okay uh so getting into second interim expenditures uh I mentioned that the increase in certificated salaries is a direct correlation to uh donations and dollars that we received in and so we increased extra hourly salaries on the classified salaries the negative there is just savings that have been captured um as we you know have continue to have vacancies you know we budget for positions the entire year when we're unable to when people leave and we're unable to fill those positions right away um you know we will we will recognize some savings with the labor shortage these dollars are pretty big and but we have been recognizing

those savings throughout the year benefits that just correlates to the the uh the salaries books and supplies uh you know really just some adjustments in in site level budgets and also District level budgets on Services it's a pretty big increase and those are a number of things primarily we as the board knows we've had some emergency repairs at Buena Vista and Carlsbad High School those were not those were not foreseen at the beginning of the year so we're plugging in those those dollars they will be reimbursed by insurance so we will have some Revenue to cover that additional service costs we also have seen increases in our special education Transportation as more students have qualified for that service and I'll be talking about that on a later item and so a number of items have

pushed that Services budget up through the year so we're recognizing that okay uh and again just the uh okay maybe just go ahead to uh slide uh 13. not much to say on those other slides they're pretty self-explanatory so on the general fund uh balance comparison you can see where we were at first interim and where we lie uh here at second interim again just minor changes with the modest Surplus that we're projecting all this ties to what I showed earlier in the evening the uh if you look at the green line that's uh this above the bottom two those are the uh the assigned and economic uncertainties that's how we calculate our reserves for the purposes of the reserve cap and so that currently lies at nine percent at second interim which is within

the 10 cap on reserves that has been triggered this year all other reserves committed are outside of that Reserve cap and so uh the ending balance we've met our positive certification uh we're able to meet our uh our reserve requirements for the current next few years we reserve we maintain our committed reserves and as I just said uh we we hit the cap on reserve sorry uh that was slide 14 Dr Churchill going into slide um multi-year projection factors we always update our multi-year projection uh every time we bring an interim report the the current assumptions as you saw in the budget report uh come over several Pages we updated the cost of living adjustment estimates as proposed by the governor and they on the Department of Finance estimate we'll update those again in May

when the governor releases his May revision on average daily attendance We are continuing to project flat enrollment uh that's enrollment average daily attendance we're watching those percentages this year very closely and we will have our state reporting coming up this month so we'll know what our percentage of average daily attendance is to put into the three-year rolling average for funding purposes uh over the next three years the one-time expenditures uh with certificated positions uh in the out years we're looking at sustaining positions that we added in the last few years with state and federal dollars for intervention counselors and other services to be sustained by the Learning recovery Grant we can do that for at least two more years using those dollars and we're evaluating classified positions that we also added during that time the

remaining questions as we look out over the next few months and prepare for Budget adoption while we do have the governor's proposed statutory Cola in next year's multi-year projection and for Budget adoption the real question is can the state fully fund the cola and so you know we're we're watching that very carefully and watching for signals up in Sacramento on what the final statutory Cola will be which we will know in April and then state revenue will have to catch up to make sure that they can fully sustain the statutory Cola our property tax Trend remains strong we do have an early estimate on our assessed valuation growth in the district which is just under five percent which is a pretty strong number remember that this is based off of the prior calendar year so

anything that has happened with interest rates and the chilling of the the housing market that won't catch up to us until the next year and then as I mentioned we do incorporate the proposed mid-year cut to the instructional materials block grant and we hope we can put that those dollars back in so on slide 16 third from the end where that that's where that last slide where I showed you our Revenue expenditure history cut off at 22.23 in the second I've added the the next two years of projected Revenue expenditures and ending balance you know we do carry a fairly large restricted ending balance however those have been the one-time state and federal dollars that we received since the beginning of the pandemic the two large block rents that we received this year so if

you look all the way to the left you can see on that black bar is barely there in 2015-16 it peaked up as we got into the recess as we got into the pandemic and now it's being whittled away to where we will get back down to where we used to be you know spending those restricted dollars first and as uh and using them for all of the purposes that we can as quickly as we can for the students that we have in the years that we receive that we have them so that black bar will continue to drop down so finally slide 17 next steps um tonight would be adoption of the second interim budget report uh we will be watching the governor's May revision which will come out we think on May 13th

uh his deadline is the 15th and then uh the proposed budget and estimated actuals will come to you at the first board meeting in June with adoption at the second meeting so at this time uh ready to turn it back to president Pearson thank you Mr Dill this is time for public comment how many blue cards been received we have not received any blue cards for this site Garcia trustee do you have any questions trustee Rawlings thank you on slide six um you mentioned that there's a 2.4 approximately 2.4 million shortfall due to the um the mid-year cut from the governor but in the first interim you talked about the potential of prop 28 dollars backfilling that money so my first question is is that 2.4 million is that the entire amount or is that

just the half of the amount that's first question sure so um the the governor's proposal is is really at the Statewide level and so uh he's he's cutting uh I think uh three billion dollars to pay for two billion dollars in growth in next year for prop 98. so he's kind of borrowing from that block grant to cover prop 28's growth next year um this is this is reflective of a one-third cut to the overall Grant which is what he proposed at the state level um and the next year growth which prop 28 dollars will be a little over a million dollars for us so as you can see there's an imbalance there between the cut and and next year's funding the also the the thing to keep in mind is the the grant that

was cut many different purposes Arts music instructional materials and was discretionary we elected to use it for instructional materials next year the prop 28 dollars that come to us will be restricted to Arts and Music expenditures and so it's kind of taking discretionary dollars to pay for a restricted program next year which is why we hope it doesn't happen through our lives thank you and so just to be clear the prop 28 dollars are not available this year correct they become available next year so that is what's creating the potential of the shortfall for this year but then it could be backfilled next year correct uh well there will be additional Revenue next year from proposition 28 it will be restricted to only Arts and Music where this grant that is cut this year is

a little more Broad in purpose a super fat so we see a projection of flat enrollment is being forecasted right and we've talked about that before what's that based on and what information do we use to project enrollment thanks great question we have a demographer that we use every year to do an Outlook and they give us a short-term and long-term view they give us a conservative projection and a moderate projection we use the conservative numbers for Staffing purposes and for budgeting purposes because it's lower and we don't want to count on dollars that might not come if the more optimistic enrollment does not come in there's there are some pitfalls with the demographers so we have to look at the dollar we have to look at the numbers and then look at our own

history and so as we see a slight growth in what the demographer would say we know that recently in last year they predicted the large growth both in transitional kindergarten car kindergarten that did not materialize so you know we think that that growth is not going to happen next year either so we back out you know some of those numbers until we see the whites of their eyes in terms of pre-enrollment or early enrollment and we'll adjust upwards if if we need to both for budget and for Staffing purposes um but it but it starts with the demographer's projection our knowledge of how the cohorts of grade levels progress through the district we know the the jumps that we get at from kindergarten to first grade we know the jumps that we get from fifth

to 6th and eighth to ninth as students go back and forth between private school and public school and so um so there's a little bit of Art and a little bit of Science in that the safe the safe projection right now is flat uh even though it's showing at least the demographer suggests that we could see some additional students next year we'll hold off until we actually see them I just have a follow-up on that is that okay I have a follow-up just true so are we making any efforts to increase enrollment or is there how do we do that or can we do that um you know I I look at things from the from the budgeting perspective rather than the enrollment person whether from the enrollment efforts you know you see our signs

out in front of our schools new to Carlsbad enroll your students um you know a as we look at the change in enrollment what we're also seeing is very large classes of high school students who are progressing through and graduating replaced by much smaller elementary school elementary grade levels this really gets into the weeds but I love talking about this thing we also look at birth rates and so the birth rate in Carlsbad peaked in 2017. and it started coming down after that and so every year it was fewer and fewer children were being born within our boundary and so that means fewer kindergarten students in the pipeline which is going to have a ripple effect as we look out over you know the next you know 12 years with smaller cohorts coming in larger

cohorts going out and so that's why you know for folks to say why aren't you going out and getting more kids well yeah those babies had to have been born five years ago to show up now um so we'll get into the time machine and do that um the the um the other the other thing that that will impact us over time but we won't see this right away is the increase in housing prices so as the cost of housing has really blown up in the last few years that means it's less accessible for younger families to move in I would say right now with the interest rates the way they are people aren't moving like they used to so you know folks that would you know downsize and empty nesters who would move out

they would create a home that a new family could move in people are staying in place right now because they don't want to pay higher interest rates higher tax rates higher mortgage rates so people are kind of sitting still that's also going to have an effect over time of the number of kids that otherwise would have been coming into the pipeline that aren't right now and you know we we watch this every single year other questions I have a question for you Mr Dale so on the one slide you showed a forecast for 23 24 24 25 where expenses exceeded revenues you want to talk a little bit about that because that's that sure deficit thing it's a it's a deficit thing on the restricted side not on the unrestricted side so um the the

revenue and expenditure lines and hopefully Dr Churchill's got that up okay um the the blue and the green that's all in that's combined unrestricted and restricted you can see in 2223 so third from the end an influx of Revenue which is more than our expenditures that is restricted Revenue by and large that has come in this year for which we had no spending plan the spending plan is really in the subsequent years so dollars came in this year we spend them next year Surplus this year deficit next year but that is in that black bar of restricted ending balance and that's why you see the black bar going down of our restricted revenue on these one-time multi-year programs that are we're spending dollars received in one year over multiple years it's a very acceptable type

of deficit it's not a structural deficit it is an intentional spending plan thank you for that you're welcome thank you um on slide 13 and 14. um can you explain why um that the other amounts that are in the reserve um are outside of the 10 cap they are outside of the 10 cap because the way that the legislature wrote it was that the combined assigned and unassigned Reserve shall not exceed 10 percent in the year following the reserve cap being triggered which is this year um so the assigned is well first I'll say the unassigned would be the reserve for economic uncertainties these are dollars that we had that the board has set in minimum of five percent threshold on so we always take that five percent minimum Reserve that the board requires and

we set that aside for any economic uncertainty so those are not assigned to any purpose other than if something bad happens we've got extra dollars on top of that we also have the assigned is essentially additional uh our assignments are extra reserves so it's it's kind of like reserve plus um and so this is another four percent on top of that um that we're carrying and you know it's prudent to have to to carry uh reserves and it's well within that uh that ten percent uh actually what we're showing is at nine percent right now uh between the two bottom assigned and economic uncertainties um the above lines uh in a non-spendable that's inventory and other you know cash that's uh that's locked down the committed Reserve those are the board commitments that have been

made in the past so the reserve uh the the local control funding formula slash basic Aid Reserve is an example of the committed reserve the technology Reserve there's an instructional materials reserve the board has said set those dollars aside for these specific purposes so those are committed they do not count under the cap so we count those dollars and everything else is either assigned or unassigned and that's below the grid I added the green line so that it was very clear what counts towards the cap and what doesn't and my last question is as you mentioned um that we're trying to maintain um some of the um some of the Staffing such as counselors and those types of things is that dependent upon the board um continuing those commitments under the lcap so our our

recommendation will be to continue those Services uh you know we've heard from stakeholder groups we anticipate that this will be an outcome you know through the lcap writing process um recognizing the value of the additional services that we have added over the last few years and so that's why when we received the learning recovery emergency block grant uh this year and it came after we had already adopted the annual budget and we looked at the purposes for which that could be spent it really aligned nicely with the certificated Staffing that we added in the last few years so you know under under our analysis we said we could take those dollars for two more years pay for that under the learning recovery emergency block grant and it will be a continual process you know in

next year and the year after as we as we look out into the future you know are these still positions that we want to sustain above and beyond our Core Staffing and if so will we have either an ongoing funding source or another new one-time funding source to sustain that or not and so those will be future budget discussions but at least for the short term we've identified for the next two years a way to sustain that Staffing Dr Churchill yeah I'll just add one thing on the lcap process you know so so uh Mr dill and Dr Nye the team have identified as as Mr Bill said the strict with funding source one-time funding source for the next couple of years we've heard through some of our stakeholder Outreach and we've even had speakers

here describe potentially a desire for more counseling support right right that's where the lcap process kicks in should the board through that process say in excess of what we're budgeting for next year we would like additional counselors we would then go through the lcap process to identify that as a need and then find an offsetting cut somewhere else to pay for that new new service right so that's the that's the lcap process in a nutshell in my opinion the well if you want to do something other than what we're already proposing for next year um we can absolutely do that we just need to find a way for it so that's my question is is that because currently in the current lcap we have the counts counselors and some of those other services that you

were talking about and we the the former board made that a priority but what I'm hearing you say is Staff heard that and has now adopted it in the budget so that so it's not necessarily dependent upon the board setting that as a lcap priority at this point right we're going to fund the elementary school counselors next year unless the board directs us not to correct and what I would say is you know we're building the plan uh we have not adopted anything you know we're still you know putting all of the puzzle pieces together and you know the next step will be at the next uh work study session you know for us to watch that as we start to align services with available dollars and you know I let I let these two

worry about the services and the people I find the way to pay for it and then we'll we'll talk to you in June any other questions okay thanks again Mr Dill see me have a motion to approve the submission of the second interim financial report as of January 31st 2023. so moved Williamson second group you trustee Williamson made the motion trustee berbeth second the motion discussion see no discussion Mr Garcia please call for a vote trustee Williamson yes trustee Ward trustee berbeth yes trustee Rowling yes trustee Pearson yes motion passes by to zero thank you thank you Miss Garcia we now move on to item 6.4 approval resolution number 21-2223 authorizing a preliminary guaranteed maximum price execution and delivery of a pre-construction Services agreement site least sublease Construction Services agreement and other acts relating to

the district's Javier Oaks Elementary school modernization project proceed this is a discussion action items and when I'll turn over to Mr Eric Dill thank you and I have nothing more to present tonight on the screen so we'll just talk through this item um this this item is approval of the construction contracts for uh Aviara Oaks Elementary School upcoming modernization the scope of work that we requested construction managers to provide preliminary pricing on was based on the plan that the board saw at last fall when the last time we brought this to you and I will say the preliminary prices in line with the budget that we anticipated at that time that being said this is a preliminary guaranteed maximum price the the final guaranteed maximum price will be provided to us following final approval by

the division of State architect so once they've had a chance to go completely through the plans and also for the Builder lucardi construction if approved tonight to go through with the architect Page by Page looking at the plans looking for opportunities to find other savings and then upon agreeing on that putting out final bids to the subcontractors and their fees are built on top of those underlying subcontractor bids so it could be lower it could be higher it really is underpinned by a public bidding process that's underneath but it's within this lease lease-backed structure and so the the um the item tonight would be to approve for us to enter into that lease lease backing Construction Services agreement with lasardi so they can begin that work and ultimately come back to you with the final

guaranteed maximum price time for public comment have any blue cards been received we have not received any blue cards for this item trustees do you have any questions I have one question Mr Dill kind of time frame on all this now yes so uh assuming award tonight this work would begin the day after school gets out uh so we there are two increments on this project increment one is the interior modification of uh the 500 and 600 classroom buildings uh and so those are two PODS of classrooms where we'll be going in and doing the interior refresh because that is work that we can get approved by the division of State architect and does not require any grading or storm water improvements so we can get that work done over this over the the summer

and it's a very fast project we'll also be demolishing the 800s classroom building in preparation for reconstruction of a new permanent classroom building on that site and so we would get all of that work done over the summer and then await the final approval of the remaining work by both DSA and the city of Carlsbad for storm water and Grading with the anticipation that we would start back up during that during the next school year for a push to get this done by August of 2024. to tell any other questions okay may I have a motion to approve resolution number 21-223 authorizing preliminary guaranteed maximum price execution and delivery of a pre-construction Services agreement sightly sublease Construction Services agreement and other acts relating to the district's Javier Oaks Elementary school modernization project some of Williamson

second Rawlings okay trustee once it made the most interesting Rawlings second the motion discussion seeing no discussion Mr C please call for a vote trustee Williamson yes trustee Ward yes trustee burback yes trustee Rawlings yes trustee Pearson yes motion passes by to zero thank you and now move on to item 6.5 presentation bike and e-bike registration program partnership with Carlsbad police trustees this is an information discussion item well now turn it over to Dr Churchill uh I'll turn it over to Dr Nye well thank you very much uh president Pearson trustees and Dr Churchill I'm joined tonight by uh executive director Evanson who's been the point person on regards to you this program that we're excited to announce tonight a little bit of background around the the certification program that we're proposing is that in

1342022 in conjunction with Carlsbad Police Department we they uh they adhered a coordinating working group consisting of officers and staff from CPD along with uh school districts located in the city of Carlsbad that included Carlsbad Unified School District Sam mode San Marcos Unified School District Encinitas in San Diego the primary goal of that was to develop a bicycle and e-bike registration program for all students if you've been on our Middle School even our elementary school and our high school council campuses you know that you know bicycles are quite The Fad and bicycle safety is a primary issue for our students and so this was uh a welcomed opportunity for us to provide feedback and then partner with the city of Carlsbad the task force research and evaluated existing e-bike programs in the area and they

looked at potential training models and they also reached out to the San Diego bike coalition as of March 2023 six officers from the Carlsbad Police Department have been trained by the San Diego County Bicycle Coalition and they've developed a new safety course for our students and for the students in the other three districts that I mentioned so what we're proposing tonight is for the 2023-2024 school year students would be required to apply for a permit to ride a bicycle or an electric bike onto school grounds students wishing to ride a bike or an e-bike must complete an application and attend a Carlsbad Police Department or the equivalency of that regarding bike and e-pack safety and submit proof of that in order to bring their bikes onto campus Carlsbad police police department will provide the training

some of the key tenets of that training again it will be required for students in order to ride their bikes onto campus safe bicycle and e-buy practices will be taught courses will be offered in summer and throughout all of next school year permits we envision would be renewed annually and the permits of course would be free of charge as well as the course itself is free of charge to any students from Carlsbad so we're continuing to work on the registration process and the paperwork that families would need to fill out we anticipate launching some type of information about this later in the spring these are a couple Flyers the first is on one of the informational nights and the training that occurred at Sage Creek High School so we used the Carlsbad police officers to

come in and and train voluntarily students that wanted to come in to Sage Creek High School and received the training and then along the right is a infographic that comes from the San Diego bike Coalition and those are really the tenets of what they're teaching in the class we've also linked the presentation link of the training itself and so that's down at the bottom of the slide deck and that'll be for public use they can see exactly what's being taught again really the the tenants are are along the right hand side so rules and Road Rules where to ride passengers talks about the importance of helmets signs and signals visibility are all key tenants so with that uh turn it back over to president Pearson and then we're happy to answer any questions that you

have this is time for public comment we have received two blue cards I call your name please come to the podium state your name and indicate whether or not you live within the boundaries of the school district you have three minutes we have the timer on the screen and your mic will be muted when your time has expired the first speaker is Scott Davison uh my name is Scott Davis and I live in the district this will be the shortest public comment I've ever given I just want to quickly thank the board for putting this plan together and the staff mandatory training was something I proposed during my campaign last August so I'm excited to see that implemented I do think there's a couple Kinks and I hope they'll you guys will work through them

but as somebody who watches kids at Sage Creek you know fly through on their e-bikes to and from school and spent three years watching them fly through the roads around this Middle School there is nothing more important than getting our e-bike Riders trained as quickly as possible they are basically riding motorcycles that are just battery powered so the sooner the better thank you thank you our next speaker is Christina McGoldrick good evening my name is Christina McGoldrick and I've been a homeowner taxpayer and parent of three in District 2 of Carlsbad for eight years the core purpose of agenda item 6.5 is safety assembly Bill 2028 was signed into law in July 2022 by Governor Newsom which allows School District boards to provide time and Facilities to any local law enforcement agency to provide bicycle

safety instruction assembly Bill 1946 was signed into law in August 2022 by Governor Newsom which specifically gives the California Highway Patrol the legislative jurisdiction and funding to teach bicycle safety in public schools via the Department of Transportation the CHP has repeatedly offered Bike Rodeo education programs to all of the schools in San Diego County and only three have participated in North County none of the participating schools were in Carlsbad in August 2022 the city of Carlsbad declared an e-bike state of emergency which is still in effect in November 2022 the Carlsbad Police Department won a state grant for over a hundred thousand dollars to increase traffic safety programs in the hope of reducing the number of serious injuries and deaths on local roads they have played a critical necessary and commendable role in keeping children

safe as they travel to and from school every day in Carlsbad in December 2022 a public records request for the Carlsbad Police Department pilot program where e-bike tickets were given the option of paying the fine versus education completed in blue of the fine showed that for the dates of January 2019 through November 2022 175 e-bike tickets were given however only 83 participants completed the bike education course in lieu of paying the fine a 47 education participation rate in 2023 the city of Carlsbad began providing after-school and weekend education classes for residents families and minors as a part of the ongoing e-bike state of emergency while the city of Carlsbad has launched an incredible campaign and put forth a commendable effort in trying to educate its residents in some cases the after-school student attendance is extremely

low one School site had less than five students sign up for the after school class whereas when a grade level assembly was held during school hours it had over 95 percent attendance being able to offer this education curriculum during school hours is critical to the success of educating the miners that use public roads every day to travel to and from school agenda item 6.5 is a safety item that can provide education for all grades of middle schoolers and high schoolers that have not yet obtained a driver's license it is important that we take advantage of all available and state-funded resources that have been set aside for public schools both the CHP the Carlsbad Police Department and the San Diego bike Coalition can work together to achieve this goal in the fall of 2023 and all

subsequent Academic School years if the beginning of the school year is too busy one option for scheduling is after the required State Testing completed in may teachers are often looking for activities to fill the time during the last days of the school year this would allow the students to be prepared for the next academic school year thank you for your time and consideration thank you staff do you have anything to add no not at this time okay trustees do you have any questions trustee Rawlings yes um has staff um received any information from the um Highway Patrol grants that are available as they were developing this plan we've heard that the highway patrol has this has this money we have not reached out to them directly in my knowledge to get more information about it

but we certainly will trustee Williamson what if a student rides a bike to school and doesn't have a permit next fall I would answer that the same way if you know a student Parks a car onto you know brings a car onto campus and Parks it in our lot and doesn't have the proper permitting we go through a progressive discipline policy and we'd enforce it would be contacting the parents letting them know that they can't do this and and going through a progressive steps of discipline if it continually happened at some point in time we'd probably preclude the student from bringing a bike onto our campus trustee Winston are the the um is the instruction going to be provided at various locations in the community yes right now that's the idea to have a North

school and a South School software is the north when have you chosen all right now I hate to return to Sage Creek as a North school but right now we have two at Sage Creek and one in Aviara as a is a soft implementation uh this school year so we don't have anything on the west part of town where we have a lot of elementary schools no no we will it's just this is the very phase and we started off as a phase-in okay just making sure that there that would be provided to at each of our sites or at least so to make it easy for our elementary students yeah I would say over by uh Magnolia uh in Valley there's probably there's a lot of e-bikes over this I do see a need

yeah but uh yeah yeah the goal would be you know as as as much availability as the Carlsbad police department has we're willing to put it on as many campuses as possible to get as many students trained so you know the capacity limitations really is on their trainers to be to be able to provide the training and so maybe CHP would provide a an Avenue for us to augment some of that training so that we could look into that as well other questions I have I just want to say first um the flyer that was I can't remember which slide it was on the flyer that the city I guess the city is producing are they going to produce that also in Spanish I would imagine that we're all happy to reach out to the

city of Carlsbad and request that if we haven't but yes I would imagine cities really been really good about that so I would imagine they would and I just want to trustee Williamson have a a question too and I wanted to state with um uh Sergeant karchis in the back they've trained six officers and they have been very supportive and they said as much as you want to use this we'll use you we'll go and then we had a soft training at Sage Creek um part of what we're talking about hasn't occurred yet in our district that's why we started doing this soft roll in but it is planned to be implemented this summer they've committed to doing as much as they as we're able to have them do this summer trust you for back

sorry if students don't have a support system at home to that enables them to attend this training well we have a hardship or a needs-based exemption or is this all going to be at school like the comment need publicly will we be providing this in during school hours or do they have to attend after school right now the plan is to have students attend either after school hours on school campuses of course um or or over the summer as examples we have not explored or or are recommending using instructional time at this point in time we've tossed around the idea of potentially the registration days doing a larger type event where students are coming in registering I believe my discussions with trustee Rawlings she had she had thrown out that idea as well so you

know the the intent is to get as many students trained as possible we haven't flushed out all the opportunities but I think when the word gets out as far as that this is a requirement next year I do think you're going to see participation increase and students go through the the training oh okay I had a different unrelated question in talking to either the PD or the city of Carlsbad are they planning to have any kind of measurement against this training to say less incidences less buy less you know what percentage so we see some impacts of this training particularly on our students I don't know that off the top of my head I don't know director Evanson if you've had those conversations we can follow up with them to see you know what measurement

uh techniques they're going to be doing tickets stuff like that but no I don't know that off the top of my head what they're going to use to measure the effectiveness of the program let me ask our trustees if they're interested in finding out if or you're right thank you thanks for the clarification I'll come back with that one thank you any other any trustee award are there going to be um opportunities for parents like in a parent University to learn about the e-bikes too um I know at my school we have students that can change kind of the speeds on the bikes and parents don't really aren't really aware of that so um I think that training would be nice for yeah and that's a great suggestion I don't know if we did an

e-bike training this year or not through parent University but it's certainly something if we didn't do it this year we could certainly do it next year we'll work with rosemary asherman to put that in the queue for a parent education because I know yeah it's it's a critical component it's likely the March 16th parent University that's uh focus on the topic of safer streets together it's likely that that some of this will be covered there yeah and interesting word we are strongly encouraging parents to be there with the students when we talk about this there's a lot of discussions happen um it does start at home that's where the bike came from um so I'm going to go back again clarification of asking my fellow trustees if they're interested with thumbs if they're interested in

directing staff to find out from CPD Carlsbad Police Department or the city of Carlsbad if they're going to measure doing any measurements of decreases or increases in instances of our students involved in any collisions or things so in other words the training is showing impacts on less kids getting involved in any accidents or collisions is there is there an interest by trustees in getting that 5-0 thank you thank you trustee Rollins thank you and um and and thank you staff for researching this and and bringing this forward and thank you to the speakers that um I think this is a very important issue that um when we're in a state of emergency and we're not talking about it in our schools I think is something that we need to do um but I did want

to see if my fellow trustees would be interested in also directing staff to research at least one uh time frame that could be available during the school day to offer this class so I want to see if there's um if there's at least three thumbs for that so there there's uh four one direct staff for that any other discussion sorry Mr Pearson if I could just um just say thank you to uh Mr Robinson uh executive director Robinson has really been the lead on our staff on making this happen and he's put in a ton of work on it he's our liaison with the Carlsbad Police Department and in addition to doing many things very well uh he's a very busy guy and he's still prioritized making this happen so thank you sir thank you

and and Sergeant karchis in the back and Sergeant sergeant thank you any other discussion on the side okay item 6.6 approval of 2022-23 Transportation plan trustees this is a discussion action item I'll turn over to Mr Dill thank you as part of uh the 2223 state budget act the state for the first time since the 80s increased funding for transportation for school districts for many decades this District was locked in at 137 thousand dollars a year in state transportation funding now there's no none of that for that meanwhile uh last year our cost to provide services solely for students with disabilities was 2.7 million dollars so as you can see we did not have the resources over the many years to put any additional investment into into Transportation the the funding that we received came

after adoption of this year's budget we did include the revenue in the 45-day budget update that you saw in August so it was included in the dollars that I struggled to show behind me earlier tonight um but the point that uh that I would make on this transportation funding is for the board to remember that this is a reimbursement for what we spent last year and this is how that funding will continue to work if we were to look at this as an opportunity to expand transportation in any way we would have to front all of the costs in in whatever current year we would decide to do that and not see six out of ten dollars until the following year as a reimbursement also this funding is only for operational costs so it would

not reimburse us for the cost of buses for buying a bus yard putting in all the infrastructure that's necessary for that I ran transportation in two districts and I know that the buses are at this point a large Transit bus is you know four hundred thousand dollars plus depending on whether you're going diesel battery and and what the range is on that capacity and range so it's a very very very expensive uh startup consideration if we were to ever expand in any way my point is the 1.5 million that we're receiving would not stretch very far for us to add any additional services in any kind of Equitable way or adequate way across the district with all of our schools So the plan for using these dollars is to cover the increase that we have

seen in providing transportation for students with disabilities you know as I mentioned earlier tonight we we actually increased that part of the budget at second interim and we added another five hundred thousand dollars to make sure that we would get through the end of this year we're hoping we come in below that but but right for now we've we've bumped that up knowing that this Revenue can help cover that the the dollars that came to us uh were tied to the requirement that the district adopt a plan which addresses several elements and one of those is how we would um provide or prioritize transportation for really all students in the district there's a couple of different levels where they say specifically tk6 also for for secondary students and quite frankly our plan is to continue

doing what we're doing and uh and we have reached out with the North County Transit District and had conversations with them about the Youth Opportunity pass which is a program that provides Transportation passes for all transfer transit system services so the bus the coaster the Sprinter if you make it down to San Diego the trolley all of that would be at no cost for any student under the age of 8 19. uh when we spoke with them they were still not certain about the funding for that program Beyond this year happy to say that they have located the funding for at least one more year and but now we have a connection with nctd through this planning process because we did Reach Out specifically to talk to them about feedback that I had heard when

I attended Dr Churchill's student superintendent advisory committee of needs that they had and questions they had and I was able to provide that to nctd so we will continue to promote the ability of the Youth Opportunity pass as a way for any student to use public transportation in our boundary we do provide services also for certain students who qualify as homeless that's been a program that's been going on for many years it's a federal requirement that we do that and it's a joint effort that all districts in the county participate in where we share the cost of that where the student is attending school where the student is is residing and it's run through the County Office of Education it's a very successful program so in terms of addressing that in the plan uh we

are we are providing that service uh as required in the transportation plan um and then finally you know I will say um you know our our efforts to make sure that there are safe routes to school are borne out by the item that was before me uh with the e-bike safety plan we've got a good relationship with the not only with the police department but also with the city of Carlsbad and Jessica Kimbrell who's our director of planning and construction um regularly meets with the the folks at the city of Carlsbad who coordinate that program because it really is about city streets and they seek input from us she then reaches out to the site administrators to provide that information to make sure that we have safe routes surrounding our schools and so that's another

way that we make sure that we that we get kids to school safely so we did discuss um what we would continue to do and not do with our standing stakeholder groups that that we meet with on a regular basis and also that we consult with through the lcap process in formulating this plan which is before you tonight which must be adopted by April 1st so it is on this agenda for adoption and I'm happy to answer any questions at this point public comment time this is time for public comment we have one blue card when I call your name please come to the podium state your name and indicate whether or not you live within the boundaries of the school district you have three minutes we'll have the timer on the screen and your

mic be muted when your time is expired speaker is Greg crudiman if I have laughs I'm shaking a little bit it's not because I'm nervous it's because I think I have first stage of hypothermia it is freezing in here I was like man I should have brought a blanket um my name is Greg Prettyman I've I don't live in the district I live in Oceanside I lived there for 20 years um I saw that the transportation item was on the agenda for the board tonight and prior to the past two years I managed your special needs Transportation contract for more than a decade and it means a lot to me the students of this District I've known both the drivers and the students for around 12 years I work closely with Chris Wright and Susan

O'Connell Suzanne O'Connell is even instrumental in helping initiate the North County Transit youth program we had a contract with the Transit Agency at the time I'm aware of the Ada opportunities and worked with Suzanne O'Connell to start that program so myself along with several of my former colleagues now work for first student and we're the largest student transportation company in the country and we have an office here locally on El Camino Real and we are servicing nearby districts part of the rapid rise in your student transportation one part is the increase in the special needs students you have such great programs here a lot of parents want their students to attend here but probably the most significant part was an 18 increase from your current alternative transportation vendor on every trip you run both AM

and PM and that rise went took your class from 65 a trip to 77.25 cents a trip and that increase came in the very first year of an awarded contract so usually once you're awarded a contract you have you need to stick to those rates but that was raised with 18 in the first year now I understand that the time and I agree that you didn't have a lot of options uh to explore when that when that increase was brought to you but I'm kind of here today to let you know you now have those options my team and my my the folks I work with are the most experienced uh in this industry that they have we kind of invented and put it together and actually Carlsbad was one of our very first accounts

so um I just wanted to suggest that you put the bid put this RFP back out to bid and I just wanted to suggest that for two reasons one well one is our team now here in Oceanside with first student we service these districts around here so you now have options I think some of the options you had previously were just not very good ones in the previous RFP you issued was really well crafted and among some of the better rfps we've seen around districts so I don't think you would need to reinvent the will or put in a lot of time and effort you can simply just reissue that RFP worst case scenario you continue with the current vendor at your current rates or best case scenario you find new opportunity new vendors in

the area that can help you reduce some of those rates so that's why I want to share with you guys tonight thank you for your time thank you Steph do you have anything there I'll just say that you know we're always looking at ways to work with our vendors and we have gone out to bid in the past um you know when we've determined that it was time to do so um you know over the last few years we've changed a number of times and so you know there's always a balance between you know continuity and price and so you know we have uh had some meetings with our current vendor and expressed issues with related to cost we're looking to evaluate the responses to those and at some point we'll determine whether or not

it's time to go out for another bid or not and when it's time we will do so Mr Dale trustees do you have any questions just two Rawlings when is our contract up for that transportation so we are we have uh options to renew it's a year-to-year contract and so uh you know it's a it's essentially a multi-year contract that we would either give Grant the option at either you know current or inflated rates depending on the terms of that and so yeah we do have the ability to shift when we need to what else okay you may have a motion to adopt the 22-23 transportation plan so moved Williamson I'll second that I hear trustee Ward yes trustee okay trustee Williamson made the motion trustee Awards second the motion discussion see no discussion Ms

Garcia please take the vote trustee Williamson yes trustee Ward yes trustee for Beth yes trustee Rawlings yes trustee Pearson yes motion passes five to zero thank you we now move on to item 6.7 election of 2023 csba region 17 delegate assembly candidates trustees this is a discussion action item we'll now turn over to Dr Churchill thank you trustees the delegate assembly is the policy making body for the California school boards Association each delegate is elected to a two-year term we are in region 17 of csba and there are seven seats to be filled in reading 17. so tonight you can vote on up to seven that doesn't have to be seven it just can be no more than seven of the folks listed in exhibit B to your board Docs so I think I'll stop

there okay this is time for public comment have we received any we have not received any blue cards okay trustees do you have any questions [Music] um for discussion purposes I'll make a motion to approve up to seven candidates for the 2023 csba region 17 delegate assembly following discussion I'll amend my motion to specify specifically name the candidates so I'm moving to approve up to seven candidates for this 2023 csba region 17 delegates assembly second callings okay I made the motion trustee Rawlings second of the motion discussion and discussion is that when we make a recommendation yes okay I have three names um and I have to say I don't know any of them I just went through the the their applications so um but I had Whitney Antrim from Coronado Delia Delia Dominguez Cervantes

and Barbara Ryan Barbara Ryan she's a short timer she's been a school board member for 40 years according to her do you want to explain your criteria or anything they they just resonated with me all I can say is that they said things that I that just I felt were good for kids and and would represent our community by so it was not scientific I did not have a rubric I just read through and those were the ones who I felt would do a good job on the delegate assembly first paperback I'd like to nominate Delia Dominguez Cervantes Barbara Ryan and Melissa Crowe and I just think they had solid comments trustee burette do you want to explain why you came to those three names I don't know any of them and I just read

through them and they resonated with me who was the third one you said Melissa croak and Warner those three were solid for me you said Melissa and I'm sorry Delia Dominguez Cervantes from Chula Vista Barbara Ryan from Santee and Melissa croak or more so those two of those were the same that I had done so that's correct okay uh we have four different names Steve Ward Whitney Antrim Kate Bishop Delia Dominguez uh Eva Lopez Cepeda Cipriano Vargas and Katrina Young who was the second one you said Kate Bishop and my recommendation I I'm familiar with their work and their advocacy for students and some of them I know better than others and the work that they've done okay so we're up to eight now any other recommendations okay since we have eight names so let's

restate the names that have been recommended and then we have to get from eight to seven names so you've got Whitney antrum Delilah Dominguez Cervantes Barbara Ryan Melissa Krug Kate Bishop Eva Lopez zepeda Cipriano Vargas Katrina Young I think someone said Eva oh I said Eva it's very evil Lopez I read that oh you did so let's start with those who made any of the recommendations do you want to withdraw one of your people or not start there well I think some of us said some of the names more than once so could we identify those let me could I just point one thing out that maybe could make a difference we have two from Chula Vista Elementary School District Delia and Kate Bishop I would prefer not to have two delegates from one District

that typically it's so that I think that's kind of been the standard so and I believe that Delia received like either two or three recommendations and I don't know how many anyway so that's just one thing that we could easily Whittle down to seven and move forward if everyone's agreeable with that that works Dr Churchill capture that and then we'll repeat once Dr Church captures that we'll repeat the seven names and then I'll restate the motion with the seven names so Whitney antrum de Leah Dominguez Cervantes Barbara Ryan Melissa Krug Eva Lopez zepeda Cipriano Vargas Katrina Young [Music] okay so I'm going to restate the motion with those seven that Dr Churchill just said to approve the following those following candidates for 2023 csba region seven delegates assembly do I have a second so mood

Rawlings second Rawlings do we have any further discussion everybody fine okay Miss Garcia please call for a vote trustee Williamson yes trustee Ward yes trustee for Beth yes trustee Rawlings yes trustee Pearson yes motion passes five to zero okay thank you okay item 6.8 approval public comment on consent calendar items trustees this is a discussion action item and I'll turn over to Dr Churchill thank you that last item was a demonstration of the high functioning of this board and I expect that this item will as well [Laughter] no pressure no pressure um so trustee Williamson made a request at the last meeting for us to discuss the protocol for public comment on consent calendar items at our last meeting it was perhaps the first time that I can recall that we had folks speaking on

wishing to speak on multiple consent calendar items so tonight staff would simply ask that you come to some agreement as to how we'll handle that and we'll move forward accordingly I'm happy to make a recommendation if it helps move the conversation along but this is time for public comment have we received any blue cards there are no blue cards trustees do you have any questions okay um before I move to a motion because we don't even know we have a motion on uh Dr Churchill do you want to make a recommendation my recommendation would be to allow individuals to pull speaker cards on multiple closed session a consent calendar items and uh and have the opportunity to speak to each of those items so my recommendation is not to force people to speak to more

than one item in their three-minute period of time it's if they want to speak to 6.1 and 6.5 they pull both cards and then they get an opportunity to speak to 6.1 and then they get an opportunity to speak to 615 so move Rawlings second Williamson okay now we have discussion on the motion trustee Rawlings um I I believe that's the appropriate thing to do since we put these items in consent for our convenience not and the public needs the right to be able to speak to each item and also there may be as we saw in the last meeting there may be multiple speaker cards on one item and only one for a different item and so they may end up with one minute for this item but then they should get their full

three minutes for the second item so I'm not trying to add to my workload and play but ultimately I think that that's the fair thing to do and I think that this is the the intent of having these items in consent is for our convenience and we need to give the public that opportunity so that's why I made the motion trustees any other discussion trustee weinson um as I've thinking through this and I I agree with I agree with that and which is why I wanted it brought back because we didn't allow it um so if someone if if there are a lot of speakers and someone pulls a card for several items okay so now that I'm thinking about so each for each item we could have up to 20 minutes on the consent

calendar okay all right then yeah I'm sorry it's I mean from my perspective it's 20 minutes per item right that's what I'm saying okay okay so I just want to make sure it's not 20 minutes for the entire consent calendar it's 20 minutes per item um because to be honest with you if they if somebody pulls it it would get its full it would get the full time as well so it's it's an agenda item it's just in there because it's normal and routine but if the public doesn't think it's normal routine if staff or we don't think it's Ramadan it gets the full agenda treatment okay I was just thinking yes as long as each item gets it's 20 minutes I just didn't want one person to be able to speak like five times

in a row and which would preclude other people from speaking but if each item has 20 minutes then I'm fine okay any other discussion Ms Garcia please call for a vote trustee Williamson yes trustee Ward yes trustee for Beth yes trustee Rawlings yes trustee Pearson yes motion passes five to zero thank you we now move on to part seven consent calendar all matters listed on the consent calendar considered by the board to be routine and will be enacted by the board in one motion there will be no discussion on these items prior to the time the board votes on the motion unless there is a board request for one or more specific items to be removed consent calendar for discussion this is time for public comment haven't received any blue cards we have not received

any blue cards may have a motion to approve the consent calendar so moved Williamson in Burbank trustee for Beth second okay Miss Garcia please call for a vote trustee Williamson yes trustee Ward trustee verbeth yes trustee Rawlings yes trustee Pearson yes motion passes five to zero thank you we now move on to part A governance team reports and requests are there any governance team reports see none are there any requests I have one trustee Williamson were you going to report on our subcommittee for the Dei survey no I was just that um we did meet as we did meet as a subcommittee and we um we have are going to be meeting again this Friday we have a survey that I believe that we feel comfortable with that we will then be discussing and so

that survey will be going out tentatively soon soon I'd be like that for a complete report yes yes we are going to be looking at it this Friday um yes we can yes it's just a report yes because we're supposed to report on subcommittee meetings that we attend in our role as a board member or as in are there any requests for super breath okay I'd like to request that the board and staff clarify the policy for pulling agenda items from the consent calendar during our last meeting the staff pulled an item from the consent calendar but it was not discussed or approved by the board at the meeting and I'd like to have staff review whether we have a policy in place that allows the staff to pull an item from the consent calendar

without board consensus Dr Churchill yeah as I understand it the request would be for us to discuss this at a future as a future agenda item yes any other requests trustee Williamson were you going to ask for thumbs on that request yes thank you for the clarification yes I'm how many thumbs do we have for that so this is does it have to be an agendized item or something you can just have a discussion with staff I'm just asking I'm asking the clarification what is the what is the request is what I'm saying repeat your request to request that the board and staff clarify the policy for pulling agenda items from the consent calendar staff pulled an item from the consent calendar last month but it was not discussed or approved by the board at

the meeting so I'd like to have staff review whether we have a policy in place that allows the staff to pull an item from the consent calendar without board consensus or approval or do we need to develop a policy procedural we have a procedure that we discussed before we request with Dr Churchill before making a Christmas discussed okay thank you Dr churches just for clarification so do we take the request and ask for thumbs or different process well we need thumbs on on on the request so the request as stated was to clarify the policy staff to review whether or not we have a policy so we we can do that in uh as staff and report back to the board and then we can determine whether or not there needs to be yeah if

there's in that case I'll report back okay that's five thumbs okay I have a request and it's based on Jefferson Elementary we have a culinary room thank you culinary room we lost a we lost a person in the Barrio who really cared about kids and actually cared about over the years always was advocating for kids to get involved in culinary science and her name was Opie Escobedo and I remember having multiple conversations that when are you going to get kids to learn about cooking and things like that so my request is that probably like a States I may need a little help here Dr Churchill my request is that we have a subcommittee to determine how to do naming uh facilities and with the idea that if the committee comes out they will report out

in the same way that we've done naming of our at Carlsbad High School the field and the football excuse me it's not a football field the field and also the stadium as well so my question is to ask all of you if you're interested in having a subcommittee to actually look at how to do naming of like rooms at Jefferson Elementary School so Mr Pearson just as a point of clarification we have a policy we do yes yes so and my request is then should I ask the request about naming it yeah all right they have to be agendas yeah the request As I understood it when we discussed it was you'd be requesting that we bring back as an agenda item aiming of The Culinary room after all Fiesta thank you okay and I

did not run this by um Dr Churchill because I didn't know it was coming in a request I would like to make a request that the survey the dni survey come before the board or at least be put into a report to the board prior to going out to the public we would do that anyways oh okay any other requests trustee Ward have a request but a question am I allowed to ask is this a clarification yes um that policy so the naming naming so that's an agendized item that for later that you're going to bring back okay and the policy cannot be shared at that time too so we know what it is okay okay it is 9 11 and the regular meeting is now adjourned our next regular meeting will take place on

April 26 2023 at 6 PM the meeting will be held at the Carlsbad Unified School District office thank you all for attending
