008present their comments and ensure that we're able to properly attend to the business of the board public comments will be limited to 20 minutes each speaker will have three minutes this is the time that members of the public have the opportunity to address the board on any non-agendized item that is within the subject matter jurisdiction of the board ordinarily board members will not respond to presentations and no action may be taken however the board may give direction to staff following a presentation when I call your name please come to the podium state your name and indicate whether you whether or not you live within the boundaries of the school district we will have the timer on the screen and your mic will be muted when your time has expired the first three speakers are first
009Mike barello followed by Kelly Le berthon and then Katrina weidler Hey look good evening my name is Mike barello I do live in the district but I don't have any kids in school right now that is a long time ago so last time we met in this room we only had one minute to speak and when you only have one minute to speak you really can't express who you are and what you want to talk about one minute is not enough time and it's really not productive for anybody for for people who want to speak for you that want to listen and then for whoever's looking in on the car on the meeting uh one minute just isn't enough time I just want to mention that um so after that meeting the North County lgbtq
010resource center wrote a press release and and I call it uh dirty journalism it really didn't Express our intent that we had last time being here we have concerns about the way the schools are being ran we have certain Community Values we're trying to express those we're not dealing in hate we don't hate children uh we've had children we love children we don't hate lgbtq what we're concerned about are opportunists that are driving some of these policies into society so I brought with me today an article that I see too often right now that doesn't occur in the mainstream media they don't publish articles like this but this is about a mother recently had a baby and at the age of 20 she had gender transition surgery decided later that it was a mistake you're
011reading her own words uh reflecting on our whole gender Journey strong and wishes she hadn't even started shall ride rejects gender Theory and gender identity calling it a scam I now realize this isn't something that's connected to reality it's sort of a fantasy I don't mean that in a facetious way it's just that's how I see it there is no science behind it and then she said gender affirming care is wrong in so many ways she said she blames profit-based motives of big Pharmaceutical so if you know what the DSM is the pharmaceutical industry they finance the DSM and they give it out to psychologists psychiatrists to prescribe drugs and you have to research it there's a lot that goes into that and defining what are dysphorias right and they create conditions and they invent
012drugs to treat them so I'm out of time Kelly lebirth on Carlsbad resident at last month's meeting some Carlsbad teachers stood here defending the position that they are not required to share information about a student considering changing pronouns and genders with that child's parents this took my breath away when parents send their children to school they are not relinquishing medical decisions and Life Choices for their child to the state in no scenario does the state have Greater Love or concern for a child than the child's parents one may think oh where is the harm in letting a child choose a pronoun instead of referring to the biological sex of an individual pronouns are now demanded to reflect a person's asserted gender identity and with the growing indeed infinite number of assertive gender identities the number
013of preferred pronouns has grown at an even faster rate some pronouns are even designed to communicate non-human identities is there not a cusd student who identifies as a cat and everyone must call this child a cat it is no wonder that children are confused fearful anxious depressed and not learning facts matter and Truth matters basic facts about sex gender and the gender binary are being denied according to activists no longer is gender determined by body and biology but by gender identity this post-modern narcissistic arrogance that we can choose our sex or gender is deeply flawed and in the end extremely tragic a young woman who is prescribed puberty blockers and hormones had her breasts removed when she was 15. she is suing the medical group and hospital that facilitated facilitated her gender transition another lawsuit
014was filed this month in Southern California uh suing a school district for quote violating the law by illegally providing minors with inappropriate gender affirming surveys medically and age inappropriate curriculum without proper parent notification the complaint States in part the district decided to provide an education that is not age-appropriate medically accurate and free of bias in so doing it violated both its ministerial and discretionary duties schools have an obligation to teach health and sex education to kids they do not have the right to teach kids about what political issues that are at best medically unsettled and certainly not age-appropriate schools need to return to teaching course we now move on to the next person [Music] thank you hello Katrina weidelich I am a teacher and parent of two children in the district and GSA advisor there's
015been much talk about how schools and districts can support the mental health of students and I think the district for implementing a variety of approaches to support students however one of the most effective and impactful methods to supporting student mental health has lately become a Target GSA clubs and their advisors GSA clubs serve many functions but most importantly support the mental health and well-being of students and improve overall campus climate for all students a 2016 meta-analysis conducted by Vanderbilt's Peabody Research Institute of 15 independent studies serving 63 000 high school students found benefits for students who attended schools with Gia with a GSA Club including 50 percent less likely to hear homophobic remarks 36 percent less likely to be fearful for their own personal safety thirty percent less likely to experience or observe homophobic victimization
016lower levels of victimization for all students if you're committed to serving the mental health needs of students and making sure schools are safe for all students then you also should support GSA clubs and their advisors we don't ask for a stipend a budget or materials just a space to support students in this life-saving work and the opportunity to educate others on how we can build an inclusive and Kinder Community thank you uh our next three speakers will be Merrell Adrian Tamara Dixon and Shauna Hearst and I should have at the beginning mentioned that when we want if you want to express your support for a speaker if you would wave your hands in that that way that we'll know and so next is Merrell yes my name is Meryl Adrian I live in the district
017um approximately 15 years I'm a former employee of the Poway Unified School District so I do have some sympathy for what you're going through um first I want to acknowledge that I was a poll worker this last week at the Calavera middle school and I want to acknowledge the fine work you've done in building safe defenses for our children that is wonderful however my real concern is what's going on behind those fences I'm here to strongly question the appropriateness of an email that was sent to a sage High School faculty by Sarah Hunter a teacher and advisor at Sage Creek on September 21st 2022. promoting the LGBT agenda the just of the gist of the email encouraged teachers to align themselves with a select population by posting safe space signs with pride flags and black
018lives matters posters an organization that has since proved itself to be a financial scam reinforcing a partisan ideology and the appointment of a GSA advisor has no place in a public school teachers are not equipped to cater to the conflicting emotions of young people while they may become aware of students in distress the proper referral would be to the school psychologist who should involve the Minor's parents it goes without saying that respect and tolerance for every human being not just to carve out of certain student groups but also teachers and administrative staff should be the norm everyone should be free from bullying or belittling regardless of their personal beliefs school should not be promoting adversarial relationships between parents and their children by creating a secret life for some students in addition students with no such
019inclinations are being subjected to overt indoctrination and discrimination if you think that I am discounting confusion and struggles with self-confidence that young people may be experiencing you would be wrong I am simply pointing out that it is parents who know what's best for their children and should be the front line for addressing their social you know emotional needs parents are the natural nurturers of their children are legally responsible and emotionally invested in them children are not chattels of the government as a school board you have been elected to provide oversight of the government schools in this District I understand that over 600 students have been withdrawn from public schools likely because their parents sought other Alternatives after seeing the indoctrination that was being delivered to their children student test stores scores are way below grade
020level shouldn't schools be fulfilling their official function of teaching the basic skills of Reading Writing math science thank you you're the next thank you very much the next speaker is Tamara Dixon Tamara Dixon hi I'm Tamara Dixon and for the woman that said Vanderbilt something about Vanderbilt um the transgender wing has been uh shut down for a while so Vanderbilt yeah Vanderbilt should not even um be even discussed okay I want to tell you a little bit about my family my sister-in-law who used to be my brother-in-law she has gone through the whole transitional surgeries bottom surgery she basically had bottom surgery about two years ago and she is having to have additional surgeries because she is having problems now I'm not saying that everyone who does a transition doesn't have problems or does have
021problems but what we need to do is be aware of what may happen to these kids and I say these kids because that is who is being indoctrinated Sarah Hunter and I think I have Krista King Nicole feltman Sarah Ryan's Beth Thompson Thomason I know all of those are GSA all of them and I don't agree with it maybe you all do but how would you like your child to come home and have their breasts removed because they want to be a boy think about it nothing is transparent in this school why is why is the GSA not not being transparent with the families why did Sarah Hunter say oh we can't we can't out the student why do you think that is that's really shameful I can't believe I can't believe that it's going
022on this day and age and Channing I'm sorry that you have to be in this kind of of time when I was young I had so much fun I didn't have to worry about all of this transgender stuff yeah we had we had blacks we had whites we had gays we had bisexuals you know who cares why does it all have to be division it doesn't and you know what more people are less divided it's the teachers that teach the GSA that are dividing us so get the kids out of here Ms Hurst good evening it's Shawna Hurst with your Carlsbad Unified Council PTA update so much good stuff I'm glad you um put me in at the end it's running late Carlsbad High School PTSA students in admin and District staff have come together
023to launch Lancer lockers say that five times it's an exciting initiative that will bring shelf stable shelves stable food to Lancers in need a formal announcement just went out today and you could sign up they're taking donations of all types of items for um for these Lancer Locker kits in October the cuc found out that Carlsbad High School speech and debate team could not compete because they didn't have enough judges at a tournament they were hosting at Carlsbad High School so it was exciting to see other PTA boards and excuse the executive teams rally to volunteer allowing all Carlsbad High School students to compete I was a judge they were awesome it's really impressed aggressive and I've been told currently Carlsbad High School speech and debate is rate 10th in the nation the PTSA also
024helped provide volunteers for the Sage Creek genius project reviews I was not able to make that but I've heard really amazing things about how impressive those high school kids are and their projects that are going on at Valley school they're launching the Viking Bean it's focused on teaching students with special needs fundamental skills the students will be delivering coffee for to teachers this is part of the special ed program there it enables them to get to know their teachers practice social skills math reading skills and learn vocational schools I'm also proud to add that Calavera middle school has also funded a PTSA Grant so that same program can launch at Calavera it's called Calaveras coffee and kindness cart and we're excited for that also at Calavera middle we had our very first ever sixth seventh
025and eighth grade dance and it was very successful and especially because Dr Ecker came back on Monday it was very stressful for him so I I thank him for that put that many kids in a room it's stressful at AOE they gathered over 2 400 canned items for Hope Leadership Academy they had a successful book fair have Reflections entries have almost more than doubled and they had amazing father-daughter dance and Che also had kind of the same turnout hope had incredible Monster Mash and lastly I had more but we're out of time but I don't I do want to at least say something to trustee Williamson and Jones to thank you for your over 20 years on the board and we wish you success and just know there's always seats in the audience if you
026want to come back I'd be happy to sit next to you and watch it on a whole different way anyways thank you thank you and actually trustee Williamson is staying it's trustee Williams who's retiring unless I misread them that's right thank you very much for all that you do we will now move to um item 6.1 approval of the consent calendar all matters listed on the consent calendar will be considered by the board to be routine and will be enacted by the board in one motion there will be no discussion on these items prior to the time the board votes on the motion unless there is a request for one or more specific items to be discussed and are removed from the consent calendar this is the time for public comment have any blue cards
027been received there are new low blue cards for this item trustee Williams has asked that we pull item 6.5 are there any additional items to be pulled may I have a motion to approve consent calendar with the exception of item 6.5 so move Jones second Rawlings trustee Jones made the motion trustee Rawlings second in the motion Ms Garcia please call for a vote trustee Jones yes trustee Williams yes trustee Rawlings yes trustee Pearson yes trustee Williamson yes motion passes five to zero thank you me I have a motion to approve the consent calendar item 6.5 so move Jones second Rawlings trustee Jones made the motion trustee Rawlings seconded the motion trustee Williams would you like to speak on this matter yes I pulled item 6.5 from consent because I will be abstaining from this item
028city of Carlsbad is listed on the PO register and the AP warrant listing my company works with the city of Carlsbad while no material conflict of interest exists out of abundance of caution I will be abstaining to avoid the perception of a conflict of interest aren't you sorry that would be the last time you'll be able to read that Mr Garcia would you please call for a vote trustee Jones yes trustee Williams abstain trustee Rawlings yes trustee Pearson yes trustee Williamson yes motion passes foreign favor one abstention thank you we'll now move to our discussion action items item 7.1 the annual audit report for fiscal year 21-22 trustees this is a discussion action item Mr Dill good evening the the audit report for the 21-22 school year is complete the board has already seen and
029approved our unaudited actuals at its September meeting in that audit report confirms the veracity of those numbers we did have a meeting with the board's audit committee with trustee Jones and trustee Rawlings who will discuss this in just a moment so I'll turn it over to you thank you Mr Dill I just wanted to confirm what Mr Dill shared the audit committee met on October 31st uh Kathy wrong or trustee Rawlings and I were present along with assistant superintendent Eric dill and director Araceli Salazar and our Christy white auditor John Whitehouse I'm pleased to report trustees that in all matter and all material respects um or sorry in all three opinions rendered by the auditor we were found to be unmodified in the district in all material respects is in compliance with federal grants state
030grants and apologize the third element is financial statements presented there was a single finding related to the expanded learning opportunities Grant while the required expenditure plan was approved on time the report the the district had five days to submit that report and miss that deadline it was though turned into this County Office of Ed the staff oversight for late submission the staff stated that there was an oversight for the late submission um the new requirement for districts this year and a one-time submission this was a one-time submission um so that it won't happen again so it's not a material finding many districts were unaware of the five-day submission deadline as it was explained to us the District staff was focused on making sure the meeting occurred per the audit guidelines and missed the plan submission
031deadline and so in that case we were given a finding um there was one uh gasby note that we discussed at length that the district will should be aware of it was gasby Number 96 this is related to subscription-based Information Technology Arrangements um this is quite an extensive uh element to the new audit guide that the district will need to inventory all of their contracts reviewing material materiality and auditing all of those so every single technology uh Information Technology Arrangement that we have outstanding will have to be audited yeah it's it's quite extensive and as you can imagine costly um and so that is my report so great job to you Mr dill and the fiscal Services team and thank director Araceli it's all star for us thank you yes thank you this is I
032like to call this the fiscal director's report card and she gets an a for this uh in her first full year with us um the the whole team in the fiscal services department does a great job with our over 12 000 budget line items keeping them straight and all of the accounting compliance and and just to confirm that one finding of the missed deadline had no Financial consequences so we had no penalties and didn't have to return any dollars it was just noted that we were a week late on that thank you very much this is time for public comment have any blue cards been received we have not received any blue cards for this item trustees do you have any questions I have a question the audit of the all the all the contracts
033is that annually we have to do this or is this like a once every three years no what we're going to need to report the value of our subscriptions to many technology Services as if they were assets as if we owned a piece of software on our server um and so now that's being treated as an asset and so we're going to have to go through and quantify all of those and if it's a multi-year agreement or a single year agreement so it's it's it's very complex we had to do something uh very similar with other types of leases this year but we didn't have many uh we do have lots of software subscriptions and so that was kind of a warm-up for next year yes yes all right any questions all right may I
034have a motion to accept the audit report for fiscal year 2021-22 as presented so move Pearson second Rawlings trustee Pearson made the motion trustee Rawlings seconded the motion any discussion thank you thank you thank you Ms Garcia please call for a vote student representative Headley yes trustee Jones yes trustee Williams yes trustee Rawlings yes trustee Pearson yes trustee Williamson yes motion passes five to zero thank you we now moved to item 7.2 measure HH Bond program monthly update trustees this is an information discussion item Mr Dill thank you there's no presentation or report for this particular meeting we did attach the monthly update of the Jefferson project so if you took a look at that you saw that those Steam and culinary arts classroom conversions are nearing completion we will be done by the end
035of the calendar year on those two projects we just now hope that furniture will show up so uh with with supply chain issues uh the furniture might not be here and it wasn't for lack of ordering on time and we tried to find that tried to stay ahead of that lead time however we've got appliances in as you saw and we're putting finishing touches on that even as we speak I was in the classrooms on on Friday and they and they look great and uh and so just a little bit of buttoning up on that and nothing else to report from last month still waiting uh on the final uh grading and storm water permits for Hope working through the final Document Preparation on on those two particular permits so we continue to follow up
036with the city on a weekly basis to move towards that endeavor thank you this is the time for public comment have any blue cards been received we have not received any blue cards for this item trustees are there any questions Ms Williams and then Mr Pearson I appreciate the new monthly status report is it possible to add just like stats in terms of start and completion to like the projected completion date that way keep an eye because when you state 40 percent we don't know what's the end date sure sure we can do that would be helpful thank you Mr Pearson do you anticipate curriculum to begin to start in those facilities uh assuming we get furniture uh we could in the second semester we can start so we just have to wait for tables
037and chairs thank you will that update be posted on on site the Jefferson status once we uh attach this to the board agenda then director Kim Brown shares it with the principal and so we put it on the property I'm sorry the the measure HH website and she's also able to share it with her community thank you if there are no more questions is there any discussion all right we will move on to item 7.3 pupil Services reorganization trustees this is a discussion action item Mr Grove thank you as you know the number of students who have special needs has grown significantly in recent years in fact uh 40 percent increase since uh 2017-18 school year that's just students who have individualized education plans IEPs in addition to that our team is responsible just last
038year for assessing 126 preschool students and over 30. 50 sorry 50 students who are not students of the districts schools but residents of the district so the these people services department is responsible for students from ages two years nine months through through adulthood and that program has grown significantly both in terms of numbers and in terms of complexity consequently we're suggesting a number of changes tonight to further enhance the ability of that team to support students first we're recommending the restoration of one FTE of District nurse that would bring us to a total of two District nurses prior to the great reception the reception it wasn't such a great reception the Great Recession the district had two ftes of District nurse and as we've heard both in conversations and lcap discussions and in a myriad
039of other conversations the outcry for additional support for Student Health Services mental health services and such we hear loud and clear we also are recommending converting or reallocating the unfilled coordinator of student health services position to a coordinator of student services position as you recall last year we suggested to you and you supported the creation of a new position that would oversee student health services and unfortunately we were looking for a bit of a unicorn we were looking for somebody who had both an administrative credential social and a nursing credential and we were unsuccessful in that recruitment effort so what we're suggesting now is that we reallocate that position you've already budgeted and approved to a coordinator of student services position that will give additional support both in the special ed realm and in student
040health services but it will not require a nursing credential it will merely require either an administrative credential or a pupil Services credential in addition to that we're recommending modifying the work year of the coordinator position from 215 days to 224 days those additional nine days for those two positions will support the extended summer program that we afford for all special day class students and simultaneously elevating the daily rate of pay for that position to be commensurate with the high school assistant principal the level and complexity and responsibility of these positions certainly warrants being placed at the same level as a high school assistant principal and then finally we're recommending elevating the director of pupil Services it says Public Services unfortunately a typo in your agenda but it is in fact pupil Services elevating that director
041of pupil services to executive director of pupil services and making that daily rate on the salary schedule five percent greater than the current certificated directors are paid the responsibility and size of the organization chart that falls under that individual is significant and we believe that the compensation should reflect that and then additionally remodifying modifying the work calendar to be a 12-month position again to provide services year round that's an additional four days of service happy to answer any questions any of you may have this is the time for public comment have any blue cards been received we have not received the nibbly cards trustees are there any questions I know I asked this question to you when you had put in the weekly report with the continue growth in iaps that with these changes that
042we'll be able to continue to manage the trend going forward I think you answered it yes correct yeah we we do not see a decline in the number of students and families looking for services such as as those provided in the student services department that's correct and then the second part is if we did nothing what impacts would that have to our district well I think anecdotally what I would suggest is that we hear praise for the members of the student services department regularly but what we also hear is an appeal for additional support for them um they will continue to limp along but it would result in a in a lack of services being provided to all students who need them a lack of of finding students who may need services and are not
043yet identified I think that students would pay the price if we didn't make these recommended changes I think if I could jump in on that and say that being able to manage those programs better would ensure that we have better compliance in providing those services and we often see Financial consequences whenever we're stretched too thin and are unable to ensure that we're providing all the services that are required by law thank you yes Mr Dill this question is for you and I apologize not asking it sooner but um does the new special ed financial model allow for the increases in in ongoing expenditures so if our Ada is growing in special ed is that acknowledged now by the state I know previously it was not it it still is not um the the special ed
044funding model is still based on average daily attendance even though we're serving all of the students who receive special education services and you know Statewide the identification of those students is going up while Statewide average daily attendance is going down so it is sort of a vicious cycle fortunately the state has provided additional funding they've leveled up the special ed we Call ab602 funding they're bringing it up to the average there are some additional allocations on top in the LA in this current year budget to provide more funding to make at least to provide more funding on a per-student basis but it still is not tied to the number of students that we actually serve so things are getting better but it's it's still sort of a backwards model in my mind but I'm an
045outlier on that any other questions yeah I have I mean I have a motion to approve the proposed pupil Services organization chart the proposed certificated management salary schedule and related actions effective January 1st 2023. so move Jones second Rollings the motion was made by trustee Jones and seconded by trustee Rawlings is there any discussion just runs I I just wanted to say that during my discussion with Mr Grove we discussed the executive director position that in larger districts this is normally an assistant superintendent position and that there would normally be multiple people doing the job that the jobs that are being done by the current um uh the the current individual who would be our executive director in this place secondly I wanted to recognize Mr Grove in in creating this position because ultimately we
046may need as we grow and as additional services and I was thinking about nutritional services for instance we've found that we had a position that we now need to hire two individuals to do that one position so this is a way in my view in being creative within our organizational chart so I want to thank you for that Mr group okay um board members we have a long-standing practice of using budget development process to consider new programs positions and practices that would have an impact on our budget especially if the expenses are ongoing um this fiscally responsible holistic approach has served us well for many years in recent years we've also used the lcap process to ensure that we receive input from our stakeholders before developing and improving approving the budget I'm uncomfortable that we're
047being asked to authorize new positions and salary increases in isolation from the budget cycle because it means we're not able to prioritize this request within the context of other identified needs I certainly see the need for this reorganization and I actually support it but I felt that I we need to as a board reaffirm and send a message to staff that we really do want to honor the the process that we have established in the past which is things like this need to come to us as part of the budget cycle so I'm just kind of asking if I I will be voting yes on this item but I am concerned about the the way that it came to us I'd like to support staff whenever possible and so I am subordinate but I believe
048that it is not consistent with our with with our practice so I I'd be interested to hear Mr So to that that's a great Point by the way um gives me a some pause not that I wouldn't support it but I think the question is Staff if when it's appropriate is why wasn't that part of this last budget process and there may be an explanation for that I don't know if that's an appropriate time but I for me I'd like to have that question answered okay and I think that I think that's a good question um Miss Rollins I would are you asking for some input to give future direction or is it more of just a statement or I'm confused what you're asking of the book I I um I am asking my fellow
049board members if you also agree that we would like things like this in the future to be brought to us as part of the budget cycle rather than one-offs mid-year so that we could um assess the entire um budget at one time rather than you know this would be I think a hundred and sixty thousand dollar ongoing expense so it that's not like a million dollars but it still adds up there was a time when we were receiving requests from staff from the community from you know from all sorts of ways on it I'm my guess is Ms Williams probably remembers this we would remember we receive him all year long and so we were being asking to vote on things and have discussions all year long and then it became quite unwieldy and then
050we would sometimes when it become time for the budget process we would our hands would be tied because we had already committed funds before we had talked about priorities as a whole so I'm just asking the rest of you are you still wanting to give the direction to staff that whenever possible anything like this would be brought to us as part of the budget cycle rather than in November so that that's what um I would say that the whenever possible but even I would even go a little bit further because sometimes things like this aren't necessary and I am seeing the rationale behind this being necessary at this time um so I would also say that if it does come before us that there would be additional rationale provided to the board of why it
051could not be potentially done within the budget cycle but so I would be supportive of that but I would I wouldn't want to tie the hands of Staff especially when sometimes things come up or it's discovered that it would be necessary outside of that cycle so that's where I would stand okay Ms Williams did you yeah no I was going to ask in terms of was that asked already to staff and prior that why is it done Midway and not not the beginning of the cycle Steph was aware of that I was going to be stating this tonight is that your if that's your question this is well this is not catching them by surprise okay but has been asked so to receive an answer I guess it was I did not ask that specifically
052so it would be appropriate to ask would you be happy to bring that for you in a future report we can we can make an accident so I understand and I agree with you in terms of but things do pop up mid-year and and issues and so I end you know and I see the need so I will be supporting this but I understand your issue in terms of Mr Jones did you want to yes thank you um and one of my questions for staff was you know we are always in a constant fight to um with finite resources figure out you know if something new comes in what goes out and that was my question for staff and they're aware of that and then additionally in this particular case um what sort of made
053it an easier decision was you know sort of the the potential costs for not delivering federally mandated Services is far outseeds this number unfortunately and and we definitely don't want to be in that situation where we're not providing those mandated services but then um Additionally the the position that we had approved over a year ago and still hasn't filled was a big factor in you know making this decision a little bit easier and understanding that um you know the employment environment is extremely competitive and you know we have an employee that the organizational chart shift actually made a lot of sense for what services need to be given for that department so for that reason I'll be supporting staff's recommendation and I appreciate and agree we always at this district and it's the only way
054we've been able to ride our footing is to say if we add something new what goes away and then evaluate that at the time we're evaluating our budget so thank you I'll be supporting it too but I do think this particularly with two new board members coming on um that we articulate under what circumstances that we've come to the board staff come to the board asking for change in a budget either emergency request or there's some other but some something that really clarifies so we know ahead particularly with new board members coming on understand that under these certain circumstances the staff has the flexibility to come to the board with a request and that we as a board member also understand so everything is out on the table and we're all on the same page
055if you will when it comes for requests out out of the budget cycle and that's just my suggestion okay uh Dr Churchill is there any um lack of clarity as far as what the board Direction has been or discussion no there's no lack of clarity okay okay all right thank you all right um Miss Garcia would you please call for the boat student representative Hedley yes trustee Jones yes trustee Williams yes trustee Rawlings yes trustee Pearson yes trustee Williamson yes motion passes five to zero thank you we now turn to item 7.4 classified management salary schedule revision trustees this is also a discussion action item Mr Grove thank you bearing in mind the prior discussion and and uh hearing you loudly and clearly um I I do this is an example of a Midstream adjustment
056that I believe is is necessary before I move into the item I would like to recognize a Personnel commissioner Renee who is in the audience this evening and um it's good to see you this recommendation adjusts the salary placement of a single classified director as you know we've had a number of Market studies done recently one was referred to earlier that being the necessary splitting of the director of nutrition services and the director purchasing services and in the course of Those comp analysis it became clear that while our objective has the Personnel commission's objective has always been to maintain placements at the median of comparable districts and that in fact we had maintained that with all the director positions with the exception of the classified Personnel director and in fact the incumbent is currently at
057the bottom of comparable districts for compensation it's a bit complicated and I don't want to belabor the point this evening but our classified Personnel director serves in a dual hat role she serves the Personnel commission as their employee to execute the Personnel Commission Merit system objectives but she also serves in a dual hat rule meaning she serves the greater Personnel department and and board and when we simply have not kept up with the market it's an inequity that I would have brought at some point this year but market dynamics uh dictate that it comes to this evening so our recommendation is simply that we move her range or the range of that position to be comparable to the median in the market and that is consistent with our practice and it would Place her at
058range 16 which is the same as the Director of fiscal services and it would Place her at her about the median thank you this is the time for public comment have any blue cards been received we have not received any blue cards trustees do you have any questions would someone like to make a motion that to approve the revised classified management salary schedule effective January 1st 2023. so move Jones second Rawlings trustee Jones made the motion trustee Rawlings seconded the motion is there any discussion Ms Garcia would you please call for a vote oh sorry sorry uh so initially I was concerned uh because it was this uh creep if you will budget creep coming up but it's very clear when we have good people we want to keep them and and we're just like
059in private sector you want to keep good people in your business you have to be competitive so initially as I said I was not real excited about that but after going through that kind of dynamic and catharsis if you will and having conversation with Mr Grove became apparent we want to keep our keep our executive director in place Ms Garcia would you please call for a vote student representative Headley yes trustee Jones yes trustee Williams yes trustee Rawlings yes trustee Pearson yes trustee Williamson yes motion passes five to zero we now move to item 7.5 live in it initial reopeners trustees this is a discussion action item I turn it over to Mr Grove thank you our successor agreement with laborers International Union of North America lyuna local 777 expired on June 30th 2022 they
060have provided reopeners to the district and this is an opportunity for the public to be aware what those reopeners are and to be able to provide comment either tonight or in the future prior to bargaining this is the time for public comment have any blue cards been received we have not received any blue cards are there any questions may I have a motion to receive lioness 2022-23 reopeners for consideration so move Jones second rolling trustee Jones made the motion trustee Rawlings seconded the motion any discussion Mrs Garcia please call for a vote student representative Hedley yes trustee Jones yes trustee Williams yes trustee Rawlings yes trustee Pearson yes trustee Williamson yes motion passes five to zero we now move to item 7.6 kudes initial reopeners trustees this is also a discussion action item Mr Grove
061this item is identical to the prior item except this is the reopeners for the Carlsbad Unified Teachers Association again this is an opportunity to provide notice to the public of the Articles which they intend to reopen and to give an opportunity to provide input and we look forward to getting back to the table and bargaining collaboratively with both our unions thank you we have received one request to speak on this item Mr Scott Davison you have three minutes please state your name and if you reside in the district foreign my name is Scott Davison I reside in the district I would like to ask the board and the district to clarify the purpose of this agenda item for the benefit of the public this agenda item describes that Cuda intends to negotiate several different issues
062in their current Employment contract however for the past several months Cuda has been telling the public that the union the teachers and the district are all on the same team and all have the same interests and that there aren't two sides but just one side when it comes to putting students first so I am confused as to why Cuda believes that there is any reason for a negotiation in the first place if the interests of the students are the same as the interests of the teachers then why does Cuda even exist the board should be able to make decisions that are in the best interest of both the students and the teachers right but since Cuda does exist despite not knowing the purpose of their existence perhaps the board and the district should simply let
063Cuda decide whatever they want and just give it to them after all since Cuda claims they fight for the best interests of the students which are the same as the best interest of the teachers then there's no reason for any negotiation something seems off here doesn't it it seems like a special interest Union coming to negotiate with our school board is doing so because it believes it has interests which are different than that of the school district otherwise they wouldn't be here at all because it's the board's job to put the students first and if those interests are always the same there's no need for a special interest Union so I'm hoping that someone here from the board or the district can clarify to the public why there is any need for this agenda item
064to exist or for any negotiation with Cuda to begin with and perhaps the board can simply assure Cuda that if that they'll represent the best interest of the teachers so that Cuda can save themselves forty three thousand dollars the next time there's an election for school board thank you Steph do you have anything to add all right um trustees do you have any questions may I have a motion to receive cuda's 2022-23 reopeners for consideration so move Jones second rolling trustee Jones made the motion trustee Rollins seconded the motions is there any discussion Ms Garcia please call for a vote student representative Headley yes trustee Jones yes trustee Williams yes trustee Rawlings yes trustee Pearson yes trustee Williamson yes motion passes five to zero thank you we now moved to item 7.7 approval resolution number
06514-2223 adopting a conflict of interest code trustees this is a discussion action item Dr Churchill thank you California's political reform act requires local government agencies to review their conflict of interest code bianially in every even numbered year to determine if it's accurate or if the code must be amended for government code section 87306.5 once the determination has been made a notice must be submitted to the code reviewing body in our case the San Diego County Board of Supervisors is the code reviewing body the appendix of the code designates those employees members officers and Consultants who are subject to the disclosure requirements of the district's code as part of our biennial review in September of this year the district determined that the following changes are necessary number one the following titles of existing positions are to
066be revised uh the first is from program coordinator to Simply coordinator the second is from Project specialist to program specialist number two the following title is to be deleted as it does not currently exist and that's Deputy superintendent and finally number three the following disclosure category is to be deleted that's the category of full disclosure for clarity the category of full disclosure is for use only by districts in which the board and superintendent manage public Investments all other districts must delete this item Carlsbad Unified School District does not manage public Investments pursuant to government code 87200 accordingly we are to delete that disclosure category from the appendix as it is not accurate prior to amending our conflict of interest code staff posted a 45-day notice in advance of taking action we posted the 45-day notice
067on October 2nd 2022. in addition to the changes exhibited indicated in exhibit a attached to board docs based on your action earlier this evening in agenda item 7.3 people services reorganization staff also recommends that you approve the addition of the new position title executive director to disclosure category 2. this Edition can be made as long as the motion and second include the approval of resolution number 14-2223 adopting a conflict of interest code exhibit a with the addition of the new position title executive director to disclosure category 2. all right this is time for a public comment have any blue cards we have received one blue card um uh Mr Scott Davidson and you have three minutes please state your name and if you live in the district [Music] my name is Scott Davison and I
068live in the district tonight the board is revising some provisions of its conflict of interest code I have a few additional suggestions the current rules prohibit teachers from serving on the school board it's an obvious conflict of interest since they would be able to vote for their own raises but there isn't any prohibition on the teachers union funding candidates for school board who would then be elected to represent their interests in other words if the teachers union funded say 80 percent of your school board campaign would you be allowed to vote on the teachers raises on behalf of those teachers you might say that just because the Union funds a campaign doesn't mean that the board members represent the union but the union certainly believes that recently one Cuda officer who at when asked why
069Cuda was spending forty three thousand dollars to fund the campaigns of three school board members uh said we want these seats so the union no doubt believes that they've bought two School Board seats a school board must avoid even the perception of a conflict of interest and should amend its conflict of interest code to insist that these board members abstain from any votes involving the Union in order to dispel this myth that those seats belong to the union my second suggestion should be obvious as well let's say the Union funds the campaign of a school board member who actually works for the Union in other words the union is paying that board member to represent their interests does anyone think that this board member would vote against the interest of the Union of course not
070so the conflict of interest code should also be amended to prohibit a board member who works for the union from voting on anything that might benefit the members of that Union I recommend that cusd consult its own attorney Mark berise who just a few years ago told the San Diego unified board that their board President should abstain from voting on any issues related to the teachers union since he was being paid by a trade Union in San Diego which was only indirectly represented by the teachers union it's hard to imagine how that was deemed a conflict of interest but the situation I just described isn't we already have a trustee under investigation by the fppc for failing to disclose the income from the very Union that represents the conflict of interest in the first place
071so it certainly seems that an amendment to the conflict of interest code to avoid these perceptions of conflicts of interest is desperately needed thank you staff do you have any comments all right um trustees do you have any questions of staff may I have a motion to approve resolution number 14-223 adopting a conflict of interest code exhibit a as presented with the addition of the new position title executive director to disclosure category 2. so moved Rawlings second Jones trustee Rollins made the motion trustee Jones seconded the motion is there any discussion Mr Pearson uh there's some pause for me uh some comments that just the speaker made that I don't know if it's appropriate for our attorney to weigh in or not I probably don't have three thumbs but for that request but I I
072do have a little pause on that only because there might be some presidents already set in the example that was stated from the person so um I guess that's my concern here on this and I'm I'm I may vote against this resolution as it as is because of that all right any other discussion Ms Garcia please call for a vote student representative Headley yes trustee Jones yes trustee Williams yes trustee Rawlings yes trustee Pearson no trustee Williamson yes motion passes four to one thank you we now move on to item 7.8 revision the board policies second reading trustees this is a discussion action item Dr Churchill uh thank you last month the board approved nine board policies as a first reading and directed staff to bring those back as a second reading we'd ask that
073you approve these nine policies as written this is the time for public comment have any blue cards been received we have not received any blue cards okay uh may I have a motion to review the board to review approve okay I think we've reviewed to to approve the board policies 0420.41 3110-3523-3550-3551-3553-4030-511 and 5141.21 and approve as a second reading can I make a motion to approve all those except for policy board policy 3550 so are you asking me to amend my motion you asked oh I asked for everybody so I'm asking for the motion to the same policies except for board policy three five five zero may I have a second second Jones okay discussion is there any discussion on the board policies that we are being asked to approve Miss Garcia would you please
074call for a motion I'd call for a vote or a call for a motion either one I'm very flexible tonight whatever when you're feeling like student representative Headley yes trustee Jones yes trustee Williams yes trustee Rawlings yes trustee Pearson yes for the sake conversation yes trustee Williamson this is a vote this is a vote no and trustee Williamson yes motion passes four to one okay would you like to make a motion for the three five five zero so I would like to make a motion for board policy three five five zero um the last sent the sentence after the itemized one through five that sentence States the district's Food Service program shall give priority to serving unprocessed foods and fresh fruits and vegetables I would like to add and not serve Ultra processed foods second
075any discussion so can I okay so um based on the research from the Harvard Medical School it suggests that there's an association between Ultra processed foods process sorry Ultra processed diets and and heart disease and the process meets that the World Health Organization does classify it as the carcinogen any other discussion I guess I'm going to ask um Mr Dill could you respond to that well similar to a discussion we had earlier this year on on processed foods I would since this is coming in the meeting I would need to find you know what the definition is what we're currently uh serving that would meet that definition if we have alternative uh foods that are attractive to students and also meet the California and federal health regulations and would be cost effective so right now
076I don't really have enough information to give you a fiscal impact or what that would potentially mean for the the items that we're serving I would have to do some additional research on that so what I'm seeing I'm not stating processed foods I'm just I'm stating Ultra processed foods and specifically those that are those types of meats is there a definition yeah that's a that's a new term for me tonight and that's I'm sorry I'm sorry yeah so did you want to bring this one back after staff has reviewed yeah okay yes yes absolutely so that's is this discussion or okay yes and the the current um the current policy states the district's Food Service program shall give priority to serving unprocessed foods and fresh fruits and vegetables so all this is doing is adding
077a layer to separate those two based on a conversation that we had several months ago that there's a difference between the ultra processed foods and um and processed foods and we already are prioritizing the unprocessed so it makes sense that we would elaborate on not serving the ultra processed so I just wanted to clarify that that this was in response to our conversation at a previous meeting with this within this area to try to meet the needs uh that staff discussed thank you and Miss Williams thank you for bringing specific words I appreciate that I would be asking that we bring it back so that Steph has a chance to identify what actually the definition of that is I would not be comfortable approving it unless we know what the impact would be so I
078would be voting no on your um on your emotional motion but I would certainly be bringing voting yes if there is a motion to bring it back after there has been some research did you want me to re amend my motion to make it as a request and what would to so we research it to research the ultra process food specifically in the meats um for clarity is it a request to bring back the impact of adding the language of the amended motion of removing or sorry of adding not serving Ultra processed foods so in other words studying the impact of the change in language that you're suggesting that's that's fine I want to make sure it's the impact not just Financial not just the but I'm but it because it's considered carcinated so I
079just want also the health benefit the health as Mr Pearson had a so um president Williamson I I support the same notion not not that I'm against what you're saying but I think there's I respect Mr Dell's position on things that he needs to research I think there's just more data that needs to be presented before I feel comfortable voting either way on it and then I do think there's that if I remember the conversations were not only the health impacts but the budget impacts and the sourcing impacts if I remember the conversation was is there availability on that as well too besides all the government regulations state and federal as well too so I just want to be really clear it's not that I'm against it but I think there's more information being presented
080to me before I get comfortable um Ms Williams are you willing to amend the motion to have it brought back at the next board meeting with uh with the impact of making this what what it would look like to make this change yes is that okay all right so with that with that then then I can we can address any other questions did you have MS Rollins I just wanted the new motion to be read back so because as the seconder I think I have to agree to it as well absolutely Miss Jones I think it's also important that the board understand the scope of the problem so if are we creating policy for a problem that's small or non-existent or is it prevalent throughout the entire diet that we're you know serving so that's
081it would be a I think an important data point absolutely so Ms Williams would you like to amend your motion so that Ms Rollins knows what it is that she would be seconding my emotion is okay okay so I think what I have is you you made a motion to approve 35.50 as a second reading and bring back for a third reading for approval with the addition of uh the statement and not serve any Ultra processed foods following the sentence that reads the district's Food Service program shall give priority for serving unprocessed foods and fresh fruits and vegetables staff will research this and bring back the impact at the next meeting I wrote that down so we can copy it make sure the impact is not fine as a physical it's also a health fiscal
082and health we will do our best are you then I second second all right Ms Garcia please call for a vote student representative Headley yes trustee Jones yes trustee Williams yes trustee Rawlings yes trustee Pearson yes trustee Williamson yes motion passes five to zero we now move to item 7.9 setting of annual organizational meeting trustees this is a discussion action item Dr Churchill sorry I was just finishing my uh my notes there um so sorry so California education education code section 35143 and 72000c2 provides that each School District shall conduct an organizational meeting to be held between December 9th and December 23rd and at the time and date of the annual organizational meeting shall be selected by the board at a regular meeting prior to December 9th 2022. the secretary of the board shall notify
083the county superintendent of schools of the day and time selected and within 15 days notice notify all members and members elect noting the date and time selected for the organizational meeting so December 14 2022 which is the the date of our regular December meeting does fall within the time span as required by Education Code and shall be specified as the annual organizational meeting at this meeting the board will elect from its members the new president vice president and Clerk that was fascinating thank you so much may I have a motion that the Board of Trustees set the annual organization meeting on Wednesday December 14 2022 at 6 pm to be held at the Carlsbad Unified School District office and published in advance of the meeting stomo Pearson trustee Pearson made the motion trustee Rawlings seconded
084the motion is there any discussion Ms Garcia please call for a vote and just for the record we don't have any uh cards thank you I'm surprised that no one wanted to talk about that I'm so disappointed uh student representative Headley yes trustee Jones yes trustee Williams yes trustee Rawlings yes trustee Pearson yes trustee Williamson yes motion passes five to zero thank you we now moved to a part eight governance team reports and requests we will start tonight with Dr Churchill thank you tonight I would like to recognize and thank trustees Claudine Jones and Veronica Williams for their years of excellent service to our school district Claudine has served on the board for nine years and Veronica has served for 12 years during their tenure we have accomplished many important Milestones most importantly during this
