good evening can you hear me in the back okay thank you before i open this meeting i would like to take a moment to recognize our teachers who are in attendance tonight as well as their families we've had the opportunity to hear from many of you over the last few weeks and i want to share some lines that i received for that we all received from a teacher within the last few hours today or yesterday she wrote as a teacher on special assignment i have the unique ability to visit our campuses regularly and spend time in all of in many of our classrooms i see teachers who are experts in their subject matter yet take the time to read learn and attend professional development to become even better teachers on their topics i see students

who can explain to me what they are learning why they are learning it and how their learning has grown i see teachers who are passionate about their subject matter and infuse their teaching with infectious enthusiasm i see students whose interests are validated and cultivated by teachers who make the learning relevant and real i see teachers using all the tools in their toolboxes to keep the learning fun and fresh from devising game like review to allowing students to cho the choice in the books they read and the topics they research to bringing in mentors from colleges and industry to inspire and coach students to tapping into students learning styles and prior knowledge to taking students outside to read study practice and explore in the carlsbad sunshine i see students making good choices staying on task and

investing in the work when the teacher has entrusted them with some freedom i see teachers who work harder than anyone i know and then when asked to do more another meeting learn a new technique meet with a parent they do i see students whose learning experiences not only have suffered only have not suffered in the long run due to the heroic efforts of their teachers administrators and support staff but who are now enjoying the benefits of a faculty whose instructional skills have been finely tuned by challenge and necessity i see teachers who take more pushback from students and parents and even their own administrators than ever before because everyone has been through an unprecedented time and everyone is trying to figure out how to cope i see students who need the firm but loving guidance

of teachers in their lives more than ever i see teachers who are tired who have struggled and persevered through some of the most challenging times in education and yet they never stop working for their students i see students who are awkwardly navigating their return to the structure of the in-person classroom after the freedom and anonymity of distance learning and with the support of their patient and compassionate teachers and their their final are finding balance in the new normal i see teachers who amaze and inspire me i see students who give me hope on behalf of the entire board i want to thank all of you who are here tonight thank you thank you thank you [Applause] um it's now 505 and i call this meeting to order per education code 351 five point five and

the collective interest of more than 600 bargaining unit members and i can tell you with confidence that we have not been seen and we have not been heard last month in bargaining an offer was placed before the team an offer that like it or not reflects the value that this district that this board places on teachers i've been told that you respond to facts so i'd like to share some with you over the course of this year i got two brief emails from two of you and two phone calls from another as the elected representative of your teachers how can you have listened or heard if you haven't listened or heard me i would have told you that teachers are overwhelmed underpaid and underappreciated i would have told you about award-winning teachers who are looking

to retire early or change careers i would have told you about the emotional tool placed on overburdened teachers and counselors to help the increasing number of students who are experiencing mental health crises i would have thanked you from the bottom of my heart for seeing the wisdom of assigning a counselor to each elementary school gratitude felt by every elementary school teacher i've listened to this year i would have told you about the record number of special education assessments our members have to complete taking necessary aids out of the classroom and adding increased work across the board i would tell you about the teachers who commute for more affordable communities chula vista escondido fallbrook and the havoc that six dollar a gallon gas and 8.5 percent inflation has on the amount of money they take home

each month i would have celebrated with you the student successes which demonstrate the brilliance of our teachers in helping students overcome uneven learning through the worst health crisis to hit our country in a hundred years i would have listened and commiserated with you about the expectations put on the entire district to carry out mandates and ever-changing guidelines perhaps after these conversations we had you and i you would in turn have a conversation with the school district you would remember the millions of lcff dollars that disappear each year into the general reserve and ask for a way to see that these monies make out their way to our members you would remember the teachers and counselors who make a difference in your children's lives the music drama debate dance speech yearbook and journalism teachers who bravely

volunteer and spend their own money to take students on sleep away field trips competitions and conferences and in remembering you would tell the district that they can do better you are all parents you all remember the teachers who are the right person at the exact right time for your children the ones who hold such a special place in their heart as gabe norton was for my oldest daughter that six years later mrs norton is part of her password for everything from a bank account to a google logon you would listen and see these teachers and you would ask the district to compensate us with a living wage increase an increase that indicates carlsbad teachers are seen heard and appreciated as you go go into closed session remember these teachers standing before you direct the district

all right good evening i'm laura pitts the ceo of carlsbad educational foundation appreciate the opportunity to provide an update and it is great to see all of you in person we are one month away for our inaugural gala the gala hopes to host approximately five to six hundred people at the beautiful omni la costa resort for an exciting evening of dinner drinks an incredible concert we are asked to the school board and community is to just come out and support i know it's been a hard year this is guaranteed to be a fun time to support students and celebrate our community additionally summer programs registration is in full swing we have elected to do our summer adventure which is our full day child care program and our summer enrichment which are specialty camps all at

valley middle school for one super location the intention of moving this is to better magnify our staff get them working more collectively and to make an environment more fun for kids it allows for more field trips it allows for more hands-on experiences and overall just wacky summer fun which is a guarantee and families are encouraged to enroll some of our programs are already reaching capacity our summer academy program will run at carlsbad high school that is our program that is for advancement credit to help students who are looking to get classes out of the way before they start the fall and that program will run our traditional hybrid model with the exception of physical education those students will have the option to do either a hybrid model or they can do in person or sorry

they can do fully online and then looking onto programs the most exciting thing i have to share with you is a change in our scholarships this year we are offering forty five thousand dollars worth of scholarships we have park sorry and i really am sorry um ryan huffias that will be he'll be followed by mark mike barello and then mike gallup um just before we start can you all hear me excellent um so my name is rylan hoffias i'm a sophomore at carlsbad high school and today i come here before you as a concerned citizen on a concerning matter now due to recent information made available to me i have found that despite inflation now being 8.5 according to cnbc teachers wages have remained stagnant prices have gone up but wages and salaries have remained

the same now this is a problem we've been seeing throughout the entire country which according to the bureau of labor statistics the real average hourly earnings have decreased 2.6 percent in the past year now the state of california has tried to respond to this by providing a cost of living adjustment or a cola of around 5.5 percent teachers however are only receiving a 1.7 percent increase instead of a coca we are presented with a pepsi poor excuses preventing salary increase now i mean no offense and i don't know the full picture that's why i'm here today now my question first is why is this money which is coming from taxpayers not being given to the intended area and following the intent of the law my second question is where is this money going i urge

transparency in this matter so we ensure that the city and the school board is using the taxpayer money entrusted to them wisely and honestly teachers work just as hard as everyone else as a student i know this just as teachers require us to turn and work on time thank you so much sorry thank you very much mr barrello and you know what i didn't mention at the beginning as if we are in agreement with someone with what they're saying if you could show it this way by raising your by shaking your fingers thank you so much we'd appreciate that mr barrilla yeah my name is mike perello i've been a resident of carlsbad for 25 years now and i just want to bring to the board's attention a matter of masks and having to do

with harms of mass cause so a lot of the studies look at the harms of mass they've verified that you have fungus mold bacteria harms that can occur in the mask but one recent paper that came up in the journal has to do with infestation of demotics mites so these masks tend to promote an environment where the population of these critters right here abound in the mass they cause all kinds of problems with the skin so the reference is in the paper there i don't have enough time because you've only given me one and a half minutes the other thing i want to talk about is vaccines uh you may have heard in the uh in the news uh the excess mortality that's occurred some are looking at ages 25 to 44. i looked at

cdc data ages 0 ages 0-25 and you see a nice trend here uh before pandemic about 600 deaths per week that were occurring when the pandemic hit that actually went down it didn't go up so it shows that this age group here was not affected by the virus even through the vaccines they were not affected it went down actually about 50 deaths a week so i asked the question why are we requesting or why are we demanding that these kids be vaccinated when they're subject to myocardia thank you mr gallup and he will be followed by kendall joyce and then aiden tapia hi mike gallup i do live in the district uh today really the only question is what other things do the contractors need to do to not be on our campus anymore okay

for you to know about the water issue it's a big issue the contractors trucks are there every day which we're reminded right and in the report from the county and the city there is no disagreement about who caused the issue correct so the fact that we have to be reminded of what went on at the school for seven months every day when a pickup truck is there i don't understand what else they have to do to get terminated or at least get put on leave at least bring in someone else to finish but the fact that they're there the fact that yesterday the school had plumbing issues and i don't have to ask who came to fix the plumbing we already know who's there right that that the all the other stuff about the investigation

cusd employees all that stuff's fine to to take due process we should not have to wait for those guys to be off the campus thank you mr kendall joyce followed by aiden tapia and then brandon faulkner oh okay can you hear me here okay um so i was uh planning for two minutes so just like uh um if i get cut off short speak fast okay you wanna hear what you say okay so i'm kendall i go to calavera hills middle and i'm talking about the dress code and some problems i think it has with today's like clothing business i guess so um in today's clothing market it can be much more challenging than it should be to find clothes that fit both the dress code and your own style this might sound a bit

extreme especially considering that most teachers or other staff members won't actually give a dress code violation deeper minor things and yet it still feels like we're breaking the rules my friends or myself will come to school with a slightly crop top not inappropriate at all and yet we'll still be afraid to take off our jackets because we don't want to get dress coded some of the rules are that stomachs are to be completely covered tank tops or no and shorts must reach below your fingertips while your hands are relaxed to the side i don't own a single pair of shorts that go below my fingertips i completely understand that there needs to be boundaries of what is appropriate and what isn't but i also believe that those boundaries need to be altered to fit today's

clothing norms in the actual rulebook the dress code does not at all fit the average closet for most of the people at our school nor does it fit what's available for us to buy the store a couple years ago it might fit better but definitely not now when i say a change in the rules i don't mean anything too drastic but i definitely mean that there should be some alterations my request would be that storage had to be appropriate but definitely not below the fingertips three to four fingers of midriff could be shown depending on how high the bottoms rise and lastly tank tops would be loud as long as they have all the rest of the rules no rebuilding necklines and not too short i feel like these are changes that should be made

to fit our everyday closets thank you for your time and consideration thank you very much for coming um aiden tapia brandon faulkner and then jason novick you're naming if you live in the district or not oh um i'm aiden tapia and i do live in the district oh and i'm talking about the dress code too um and yeah my name is aiden i'm an 8th grader who goes here and i'm here today to talk about the dress code at my school because i think it's unfair and should be changed so that the students don't get dressed coded for the minor things on their clothing and yeah one example i have of this is a kid had walked onto campus student walked onto campus and he had a like a hat that had foul language on

it and i had on a shirt a playboy shirt white with the little bunny which i know is maybe a little too inappropriate for school but i had a talk with staff and i had got dress coded while the kid with the hat had not uh gotten a talk or anything and the thing that got me upset was that he got to wear the hat the very next day because no one had said anything and i think that it should be changed so it could be used more consistently and uh that the things we were getting dress coded for like i understand the playboy could be too much and i also know that the hat the foul language should be too much so i i just would like for a more clearer way to uh

see how the dress code can be followed because you know gray area and that's it or whatever it's called thank you thank you very much for coming and speaking with us brandon faulkner jason novak and then crystal jones hi my name is brandon faulkner like rylan i go to carlsbad high school and i'll be talking about the cost of living increase our teachers right now are receiving a 1.75 cost of living increase when all across the board other places are receiving a 5.5 increase currently inflation is 8.5 percent it is at its highest it's been in 40 years since this has been since 1981 40 percent of use 48 of gas has gone up in the past in the past 12 months alone as well as 35.3 percent of food and and now 8.8 of

shelter costs have gone up in only the last year and the fact that teachers have to come out and argue against this today is is just like it's just not acceptable because they because across the board more places are receiving this 5.5 increase when teachers themselves should be receiving this 5.5 increase just to combat the today's today's inflation price inflation prices thank you thank you very much for coming and speaking to us jason novak or no followed by crystal jones christian walter and then kim mcconnell hi my name is jason nowak i'm an eighth grader at chms i'm here today to talk about something that we used to do that most people loved something that we did over online learning but was abolished after last year this was what is commonly known as self-paced learning

the days where nobody would get into an online meeting or go to class the teachers would send us the assignments and we'd do them a couple of good reasons to bring this back would be giving teachers and students some time to advance giving students and teachers time to time to be creative and expand their learning and it gives everyone some time to gain sleep instead of barely getting seven hours students and teachers can get caught up on lots of work on self-paced learning days after students get done with their work they can do their missing assignments as well teachers can use this time to grade all their work instead of instead of having to do it for hours after the school day is over during wednesday which was when it happened teachers and students can

be very productive not only with school work but also with personal stuff as well such as art sports and exercise a lot of people at school complain about not getting enough sleep this makes them tired and they don't perform as well in school since they can sleep in on a day in the middle of the week they're able to get more sleep and come back to school nice and rested also many people in the business world have been trying to get a four day work week you can't turn on the news without seeing something about it this would be the district's version of that according to abe ibanez an 8th grader at chms this is what he thought about self-paced learning i like those days because we can just sleep and wake up when we

want students would wake up feeling refreshed at least for me i could finish class work without having to worry about getting on the google me call at a specific time and just be chilling at my house thank you so much for coming and speaking with us we appreciate that we'll now move to crystal jones then then crystal walter and kim o'connell hi my name is christo jones and i live within the district my comments are concerning the contaminated drinking water incident at hope elementary hope elementary is currently providing bottled water to students and staff that desire it this poses the question is the drinking water at hope safe to drink or not providing bottled water does not convey the message that the district is confident that the water hope is safe to drink we acknowledge

that the reclaimed water supply has since been disconnected however no data has been shared with the community that confirms the drinking water hope meets federal and state requirements since the reclaimed water supply was installed in hope at 2017 the legally required annual cross-connection tests have not been performed the last water test report that was shared was from clearwater technologies and that was for samples taken on 24th of february this year from the cross connected supply even the data for the uncontaminated uh carlsbad city water sample in that report are extremely limited and do not convey even whether the city water meets the national requirements by law you have assumed that you will that we will take your word that the water is now safe to drink please perform a proper and relevant water test to

prove to the hope community that the water is now safe to drink and it meets federal and state laws thank you [Applause] hi my name is krisha i live in the area i'm a daughter of an immigrant from communist poland growing up my father would consistently talk about the evils of communist indoctrination of marxist principles in his school as a young boy there is a polish saying about communism that all men have this have the same regardless if they are standing up or lying down we are now saying equity is fairness and justice but in reality it's about all individual individuals ending at the same place critical race is against traditional american values and is based on marxist critical race core premise is that there are only two groups of people in society the oppressor

and the oppressed a concept is also the foundation of marxism the widely discredited economic and political philosophy that divides people into two classes capitalists and workers the illiberal system of in countries like china and former soviet union cuba and venezuela have been based on marxism which resulted in the deaths of nearly 100 100 million people in the past 120 years critical race theory is against teaching children america is great and is for unamerican illiberal values we must prepare our kids that the ever shifting world by teaching them the exceptional nature of our imperfect yet exceptional nation and its steadfast commun commitments to liberty and equality we can only do this by uniting together and behind the greatness of america which lies in the goodness and its ability to repair and transcend according to justice scalia

in the eyes of the government we are just one race here it is american critical race theory rejects all these positive thank you kim mcconnell please state your name and if you lived in the district or not all right thank you my name is kim mcconnell i do live in the district on february 24 2022 a cross connection was found which combined treated sewage water and potable drinking water at hope elementary it is unknown when this crux connection occurred what the quality of the drinking water was before the discovered connection and what the quality of the water is at this present time as there have not been published test results after school shutdown and subsequent reopen on february 27th while the assumed inlet source through cross connection of irrigation water has been removed it is

not clear what the quality of drinking water is at hope elementary as actual repairs have not been done to effectively manage the issue for district correspondence to parents only potable water is being provided to the school at this time the cross connection has been attributed to non-permitted work during recent and ongoing construction on site at hope elementary plans for construction of hope elementary were approved in june 2020 on july 30 2020 stop work order was filed by the city of carlsbad for a portion of the project this order is still in effect after multiple resubmissions in city review with the findings still unacceptable to remove the order there is no additional information or activity and the school remains a construction site while staff and students attend despite the stop recorder it is unclear what other

unauthorized work has or will occur and what monitoring if any will be done to avoid recurrence of cross-contamination of water supply or other preventable errors that would make the school unsafe for students and faculty while it is understood that there is current ongoing investigation it's noted that there will not be additional information until after this is done this process is expected to last around 90 days while we wait to determine the why behind this unfortunate incident can we now ask why not why not provide a clear and organized action plan for improving communication within and across the usd offices and schools thank you mr dill will there be any additional uh water test that will be available to the community yes we did do an additional uh total solids test along with the content of

that we're waiting for the results and and i can check back with the city of carlsbad they were the ones that tested the water following the cross connection uh on two occasions before the uh submitting those to the state water board and the state water board reviewing that and giving permission for us to reopen so i can see if i can get that from the city of carlsbad which would confirm that it was drinking water uh coming through the pipes thank you thank you very much we we now move to item 6.1 the approval of the consent calendar all matters listed on the consent calendar are considered by the board to be routine and will be enacted by the board in one motion there will be no discussion on these items prior to the time

the board votes on the motion unless members of the board staff or the public request specific items to be discussed and or removed from the consent calendar now is the time for public comment we'll hear from callers first followed by blue cards from the audience ms garcia if any caller wishes to provide public comment on this item press star 9 to indicate you wish to speak we do not have any callers that have indic to speak and we do not have any blue cards oh i'm sorry looks like they just raised their hand so we have one caller and this is for the consent calendar item 6.1 thank you they will they have three minutes speakers are asked to state their name and indicate whether or not they live within the boundaries of the school

district when we call the last four digits of your phone number press star six to unmute you will have three minutes we will have the timer on the screen and will mute your mic when your time is expired the first caller is 2842 please press star 6 to unmute caller two eight four two please press star six to unmute we will move forward um trustees are there any additional items to be pulled i have one that you that you okay um ms williams has indicated that she would like us to pull item 6.6 may i have a motion to approve the consent calendar with the exception of item 6.6 so moved rawlings second pearson trustee rawlings made the motion trustee pearson seconded the motion ms garcia please call for a vote trustee williams yes trustee

rawlings yes trustee pearson yes trustee williamson yes motion passes 4-0 thank you may i have a motion to approve item 6.6 so mood rawlings pearson second trustee rawlings made the motion trustee pearson seconded the motion trustee williams did you want to speak on the matter yes thank you i pulled item 6.6 from consent because i will be abstaining from voting on this item city of carlsbad is listed on the po registry and ap warrant listing my company works for the city of carlsbad while no material conflict of interest exists out of abundance of caution i want to avoid the perception of a conflict of interest thank you ms garcia please call for a vote trustee williams epstein trustee rawlings yes trustee pearson yes trustee williamson yes motion passes three in favor one abstention thank you

we now move to our discussion action items item 7.1 development of the 2223 local control accountability plan final 23 goals and success indicators this is a discussion action item i'll now turn it over to dr nye thank you president williamson trustees and dr churchill staff's happy to present exhibit a which has incorporated the proposed changes made at the march 23rd study session and what you have before you tonight is the draft 22 23 goals and success indicators the next step after approval tonight's goals and success indicators is staff to align actions and services and we'll bring that back at the next boards at the next month's board meeting staff's happy to answer any questions that you have at this time dr nye would you have any concerns combining the two parent university items into one

success indicator and then just dividing the two components just like we do with math and language arts scores no i would not have any concerns to do that any other questions ms rollins when you say you wouldn't have any concerns my understanding was that it would be difficult to to show i guess success in that area if they weren't bifurcated in our last discussion yeah i think um one of the areas that we could do we would still have two metrics that would be used and we would treat each separately as an area of success even though it's listed as one item could you give me an example of what that would look like as a matter of fact i can't let me cast it up for you hold on one second so under this

example what we did is we combined the two success indicators into one specifically dealing with parent university and now reads participant reported relevance of parent university sessions will be at 90 or higher and participation of sessions will increase by two percent annually and then we have the success indicators along the right hand side or the targets along the right hand side that you'll see there so in this case it would be two separate targets that staff would be reporting on and we'd either hit both of those targets or not hit those targets but we would count them as separate targets so just one more so just to be clear that if both are not met then the success indicator has not uh then we have not reached success in that area is correct we would

indicate that we met one of two okay um now is the time for public comment of chris are there any more questions now is the time for public comment we'll hear from callers first followed by blue cards from the audience ms garcia if any caller wishes to provide public comment on this item please press star 9 to indicate you wish to speak and we have one caller that has indicated they would like to speak and we do not have any blue cards for a total of one comment then that the caller if if if they were able to make it through we'll have three minutes speakers are asked to state their name and indicate whether or not they live within the boundaries of the school district when we call the last four digits of your

phone number press star six to unmute you will have three minutes we will have the timer on the screen and we'll mute your mic when your time is expired it looks like the color just dropped off so okay we will move on all right i mean i have a motion to approve the preliminary goals and success indicators for the 22 23 local control accountability plan so moved second rawlings trustee williams made the motion trustee rawlings seconded the motion discussion miss williams and then ms rollins i just wanted to point out the modification that trustee williamson made is similar to what we have for ela and math showing two sections ms rollins um i'm not hearing that we we didn't pass the modification um and so if that's i would not be in favor of doing

that just because i do believe that it becomes confusing on the measurement and if it's uh if it meets the success indicator or not um if we wanted to move something from the back tab to the front tab i would be in favor of having this on a back tab but because we used the front tab for so many different items i would not be in favor of combining those two at this time so what what i believe we voted on or at least that we i that i motioned and seconded um would be the what we have before us any other discussion i would like to combine them into two i believe that that it anyway i think that it would be wise to have them combined as dr nye had had shown and

so trustee williams did you make the motion i did would you be willing to amend your motion to combine the two success indicators relative to the public to the parent and yes so i will be yes i'm so amanda restated to so i'd like to amend my motion to combine both parent university success indicators into one and trustee rawlings had indicated that she was not going to be in support of that so would someone else second that motion of the immense question okay uh any discussion about that yes so i i agree with trustee williamson regarding the parent university because it is each of our success indicators identify a certain certain area it's it makes it sense to combine parent university since they are both reflecting both parent universities so it makes it cleaner and

splitting that up up is similar to what we have for the s back where it splits up to ela math and science any further discussion oh yes mr pearson not related to this but it's one of the other success indicators administering student check-in and surveys to measure school safety school connectedness school climate and social emotional mental health at least four times per year with at least favorable rating using the kelvin pulse initially i was skeptical of using this tool but i have been convinced that it's going to be a lot more in depth and we'll have a lot more feedback from students a lot more frequency of students and we can really regulate and see how our students are doing in terms of all those areas so i just want to say it's good work

by my colleagues good work by the cabinet and staff to bring this one and we can pay attention to it four times a year now thank you without further discussion ms garcia would you please call for a vote of the amended motion student dalen rose yes trustee williams yes trustee rawlings no trustee pearson yes trustee williamson yes motion passes three to one thank you we now move to item 7.2 measure hh bond program monthly update trustees this is an information discussion item i'll now turn it over to mr eric dill good evening trustees and just allow me to cast here okay let's try this now all right i think my report will be will take even less time than it's going to take me to get this up on the screen because it is pretty

brief this evening just a quick update i told you just like last time i had this working correctly before the meeting all right thank you everybody for telling me what's behind me right now uh this was meant to be a brief update on on our progress and some remaining work to be done uh that's currently underway uh so a couple quick updates on on kelly and hope these photos are just uh a week or so old you can see the exterior has gone up on on kelly so it's really coming together on the multi-purpose room and again i see this every day and so i get my update uh twice a day as i drive by the school and it's looking it's looking very nice you can uh you can see also that uh the

interior uh framing and drywall has gone up so it's really starting to come together uh inside the multi-purpose room i've already shown you photos of the of the remodeled library in the steam classrooms our next ioc meeting will be the joint tour with the board in the ioc so you'll get a chance to see that in person come this july we also are working on the kitchen area so you can see the interior of the serving area we've been putting that kelly green paint up at kelly elementary so so that expansion is is coming along on the left you can see the the interior work is being done on the outside still not as pretty as the multi-purpose room is quite yet but you get a sense of how much we pushed that building out

to increase the size of the kitchen so it's a pretty good illustrative drawing so remaining work to be done um the original scope at kelly and hope as the board is aware did not include the level of improvements that were necessary for us to get the stormwater permits from the city of carlsbad also the grading permits we have not yet amended the lease lease backed contracts with the construction manager to include to pull that scope of work in so with hope we still have the storm water and grading permits still pending at kelly we we have proceeded with the grading work because we needed to do that to get the the multi-purpose work room work done but we've run into some unforeseen conditions on the storm water improvements which have required some redesign and resubmittal

to the city so due to these delays and not yet having the the permits from hope uh and having to to reconfigure the um the modifications at kelly uh our plan now is to get across the finish line with the contracts as they are with the scope of work that it is and then we would not be able to accomplish this work over the summer just because of lead times for materials so our plan would be to next summer come back as a separate phase of construction complete that work so it would be a new contract that would be either rfp'd or bid out under a separate phase of work so what's remaining to be done at kelly right now we are working as i mentioned on the multi-purpose room the kitchen expansion coming up

next we'll move into the playgrounds there's some work we'll have to do to move their garden around and then do the restoration of the fields from the lay down area where we have all of the construction we will have a change order that we will need to bring back to the board at some point that will capture those costs that were incurred during the time that we had the stop work order in place and the contractor did incur some additional costs due to that so that's still pending and we'll bring that forward at some point in the future at kelly next summer as i mentioned we will move forward with the under which is an underground stormwater retention basin so we have a vault that we're going to have to put in that will be

done at the front of the school and we can't get that done during the school year and the lead time is too long to get it done this upcoming summer even though we do have the permission to do it at hope as soon as we do have the stormwater and grading permits we'll have city inspection of a new fire line that we installed we will finish the concrete work you might have noticed that strip of unpaved area uh outside the new classrooms and also in the lunch area is currently unpaved that's because uh that's related to the grading work and so until we have that uh permit in place we can't concrete over that because we also could have some inspection of what's underneath there so we didn't want to put that in only to

have to dig it up later um once we have the concrete in on the lunch sage structure then a lunch area we can then finish with the shade structure that goes over it and then next summer as i mentioned we would have a separate project for that stormwater retention basin which is above ground in the field area so that's what's remaining uh and happy to answer any questions related to uh these projects so mr dale with the extension of the completion date now being next summer um what is how's the communication going with the kelly community well the the the work that would uh remain to be done the stormwater work is really it's underground work that it doesn't affect classrooms teachers it's it's infrastructure type of work so you know it's not going to

be disruptive to teachers teaching students or parents in any way so we haven't messaged we haven't messaged that this one piece will have to be pushed out to the next summer um you know if this were something like the mpr wasn't going to get done or the lunch area or you know any of the things that that would affect the teachers or students we would have put those messages out but this is really underground infrastructure work that probably only people like me really care about thank you and people who love stormwater retention yeah any other questions ms williams so does this incur additional cost or is it sorry yes it will be an additional well the the work in and of itself is additional above and beyond because it was not included with the original

scope of work in that project and so we have not while we have an informal budget for that because we haven't actually costed that out formally with subcontractors and a cm in place we haven't put a final number on it so we have we've zeroed in on it we know we're going to need to do that work the other question would be would doing this next year because of construction escalation that happens every month um you know conceivably you know there could be some increasing costs what we are looking at doing um with respect to kelly is um is actually procuring some of the underground vaults in advance and that we would procure that now and then we would just have a contractor install it for us so we will we'll try and beat that

cost escalation thank you and that was miss kimbrell's idea and it was a very good one so um thank you for answering my questions in advance um but i did have a follow-up to the kitchen at kelly um as you stated we still don't have a kind of a stable number that's reliable on lunches being served will we have the ability to expand at kelly if necessary after building what were is already in progress yeah unfortunately as you can see that that building is pretty much set in place uh you know and i can't really see where we would be able to do more modification um you know we do have an expanded kitchen so we do have expanded capacity unfortunately we were already out of the gate with this project when the state chose

to extend the no cost uh breakfast and lunch program and so that that that was a game changer but we were already underway with this project similar to how we had just completed magnolia and we had just completed hope so we're taking this into consideration for future phases and we have not yet reached a plateau on our lunch participation we continue to increase meals every month and so until we figure out where what the normal is um i'm i'm kind of holding off on on kitchen redesigns and serving redesigns but i guess with those that are already in place they're already moving forward what is the contingency plan to deal with the expansion of these uh no-cost meals sure sure so you know i would i think my default on this would be to kind

of go back to what we used to do when we had kitchens that couldn't meet the needs and provide all the serving lines which is you know carts uh you know maybe looking at where additional windows could be put in on the sides of buildings you know to open up another serving line uh at the elementary i wouldn't be putting in vending machines but we think about that at secondary if we have vending machines with with healthy choices that meet the uh with that meet the nutrition guidelines that can draw off some of the the the demand off of the lunch lines there are even vending machines that put in reimbursable meals that we could do too so there's a number of ways that we could that we could adjust in the future but unfortunately

with those that we just finished you know we'd have to take a really good hard look at it before modifying the buildings and then i'm assuming salad bars do help with that as well correct which have returned yeah salad bars do help and they are back at elementaries as of last week now is the time for public now it's time for public comment ms garcia we do not have any callers on the line and there are no blue cards for this item okay um any discussion board members none okay we will now thank you very much mr dill we will now move to item 7.3 annual proposition p and measure hh performance performance audits for fiscal year 2020 to 2021 trustees this is a discussion action item mr dill thank you again and we have

with us this evening mr greg dowell who is the chair of our independent oversight committee for measure hh also shauna hurst is in the audience as well another long time long serving member uh who is now our taxpayer association representative on the committee um every year we do have our independent auditors conduct a what is actually an extensive audit of uh of our bond funds and they produce that report to you and we share that at the same time with you and the members of the ioc give the the chair and vice chair along with two board members an opportunity to review and question in advance and then uh mr dowell comes with respect to to this particular audit report to give the ioc's uh impression of the audit report to you prior to your

deliberations for acceptance so mr dowell thank you for being here thank you mr dill my name is greg dowell and i am a resident of carlsbad and i'm also the chairman of the independent oversight committee and i'm also joined here tonight by shauna hurst who is one of the committee members and we have several others who are not here vice chair j marquand sam ward brenda hall michael zepeda and our newest member marla evans and we are charged with seeing that the money which has been allocated through our bond measures are properly spent in our building program on march 24th i joined eric dill trustee rawlings ioc vice chair dr markwand at a on a conference call with john whitehouse cpa and he is with christy white agency cpas in san diego they are our

independent auditors assessing carlsbad unified's expenditures and governance of the two school bonds prop p and major measure h for year ending june 30th of 2021. this is our annual audit but this year's audit was special for well one other reason and that's because it's the final closing audit for prop p spending which received voter recognition or approval way back in october of and the funds are now expended so that's good news um our auditors reported back the good news to us which is that the bonds meet what they called a clean audit status that means that bidding requirements financial controls and reporting met all state laws and the requirements laid out in the voter-approved bond measures the auditors selected a very large representative sample of facilities projects expenditures for each of these measures for measure

h they tested 38.2 million dollars of non-personnel spending representing 77 percent of the total measure hh expenditures that's much larger than they typically do in any audit and for prop p they test tested 1.1 million dollars in non-personnel spending representing 96 percent of the total prop p funds that were expended and as i said now have exhausted that fund and they concluded that all of the expenditures were valid allowable and accurate and in compliance with the terms of the ballot language the district approved facilities plan and applicable state laws all contracts and change orders were properly executed and all financial statements are accurate that's as good as you can get so now there are yes yes there are 36 pages to these reports and i know you're dying for me to just review every one

of them but but i think i'm going to cut to the chase here and i can abbreviate it with two identical statements that appeared for the um the auditor's approvals of these these measures and they said in our opinion carlsbad unified school district complied in all material respects with the types of compliance requirements referred to applicable to proposition p and measure hh bonds for the year ending june 30th 2021. that's a clean audit and it's a pass a high pass for carlsbad so based on this audit the independent oversight committee commends the district on your controls and governance with regard to our bond approved facilities projects good job thank you very much mr del for that very interesting report we appreciate that um but does amen board members do you have any questions okay uh

time for public comment ms garcia we do not have any callers on the line and there are no blue slips for this item all right then we will move on to make a motion for it to approve the prop p and measure hh performance audits for fiscal year 2020 as presented so move second pearson trustee williams made the motion trustee pearson seconded the motion is there any discussion ms rollins i just want to thank all the members of the committee as well as our auditors and mr dill it was a very quick meeting and very pleasing because we did not have much to discuss except for our big success in our audit so thank you all for um contributing and being there to our success thank you very much i have got the same remark

uh sentiments mrs garcia would you call for a vote student representative dalen yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes motion passes unanimously thank you we now move to item 7.4 resolution number 33-2122 statutory school fee increase for new residential and commercial slash industrial construction trustees this is a discussion action item i'll turn it over to mr dill thank you again this is a routine matter which the board considers every two years following action by the state allocation board to increase the maximum statutory school fees which may be charged to residential and commercial development we engaged a consultant to prepare a study which would justify an increase to the developer fees following that work the report does justify the increase and that the impact of future development on enrollment and

school facilities needs is greater than the maximum fee so we are recommending to the board that you adopt the resolution to increase the fees which would take effect 60 days from this evening just for some information the report identifies that there are 4054 residential units planned within our boundaries to be built over time that would produce uh just over 1100 students for us in the future so you know while we have seen some fluctuation in our enrollment should this development occur you know we would continue on a growth path and it would justify passing on those impact fees to developers the fees for residential are four dollars and eight cents currently uh we're asking that you raised to the maximum of 4.79 and it's 78 cents for i'm sorry 66 cents for commercial and industrial

rising to 78 cents according to the state allocation board thank you mr dill are there any questions then it's time for public comment ms garcia and we do not have any callers online and there are no blue cards for this item may i have a motion to adopt resolution number 33-2122 statutory school fee increase in accordance with the allowable statutory school fees for new residential and commercial slash industrial construction exhibit a so moved rawlings second williams trustee rawlings made the motion trustee williams made this seconded the motion is there any discussion ms garcia please call for a vote student representative dalen yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes motion passes 4-1 i mean sorry 4-0 thank you we now move to item 7.5 declaration of need for fully qualified

educators trustees this is a discussion action item and i'll now turn it over to mr rick grove thank you this annual resolution is required by the county to be board approved and on file with the county prior to the end of the fiscal year preceding the need so these are done prospectively should the need arise to hire a teacher under some sort of emergency permit are there any questions mrs rawlings do you anticipate that we would have that need next year what typically happens is if we have a mid-year vacancy in a shortage area for example special ed or if we have an english language student move into the district during the year and because of class numbers is placed in a teacher's room that does not have a full clad authorization those are the

typical scenarios where this would would happen we don't intentionally go out looking for folks that don't have full credentials any other questions time for public comment and we do not have any callers online and no blue cards for this item i have a motion to approve the declaration of need for fully qualified educators exhibit a somo pearson second williams trustee pearson made the motion trustee williams seconded the motion is there any discussion ms garcia please call for a vote student representative dalen yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes motion passes 4-0 thank you we now move to item 7.6 of employee appreciation month resolution number 34-2122 day of the teacher and resolution number 35 2122 classified school employee week trust trustees this is a discussion action item i'll turn

it back over to mr grove thank you carlsbad unified is truly blessed to have exceptional staff it is fitting and something we do every year we honor them during the state designated periods for recognition of teachers and classified employees this year the day of the teacher is may 11th and the classified school employee week is may 15 through 21st this is often causes confusion in the community in as much as the national week of the teacher precedes the state day of the teacher by a week but in as much as we are a california state school district we we pass the resolutions of our state any questions a public comment we do not have any callers online and we have one blue card for this item uh the one either person who has filled out

a blue card is jb scranton uh please come to the podium state your name and indicate whether or not you live within the boundaries of the district you will have three minutes and after the three minutes your mic will be muted man please the board jb scranton san diego's number one substitute i do not reside in the district madam chair resolution number 34 purports to declare may 11th as day of the teacher once again this is a cheap and superficial way to pretend that you support teachers when in fact you disrespect and disregard us at least when it comes to substitutes we are the workhorses the backbone of california public education we do the job no one else wants to do you have to rely on the great invisible cadre that is the substitute teacher

pool in order to function on a daily basis carlsbad has created a toxic work environment for substitutes you've been warned about this before that horse on you have for an hr director in rick grove has polluted this workplace grove is retaliatory deceitful he keeps two sets of books and he operates a secret kangaroo court there's nothing but contamination coming out of his office not a single one of you has ever held a california teaching credential not even a substitute permit you have no idea what it's like to do the work no one else wants to do before you enact another meaningless proclamation why don't you clean up the pollution first this proclamation is worthless in the time remaining i want to thank the students who spoke out in favor of boosting teacher salaries there was

no such comment from any adult in this room i yield back my time um is there i mean i have a motion to adopt resolution number 24-2122 exhibit a and resolution number 35-20 exhibit b designating may as employee appreciation month but amended it's a 34-2122 and move to perp thank you for that correction and second williams is there any trustee rawlings made the motion and trustee williams seconded the motion is there any discussion i would just like to say uh during this time to me this is more than just a piece of paper it's uh the words that have meaning and they're very heartfelt so thank you thank you and i will just mention i do have a california teaching credential it has expired but i yes i i do have one um we will

now um have yes i'm sorry i'd like to also mention i i think the last couple years have been very difficult years on teachers and on staff and i i would hope it's going to be received in a way that we are acknowledging this period of time or acknowledging the value that teachers put into their trade into their craft into the profession thanks thank you as i'm looking at the resolutions so that it looks like the day of the teacher is 34 21-22 24 and and the the other the classified is 35. that's correct okay okay so just make sure got it okay um ms garcia please call for a vote student representative dalen yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes motion passes 4-0 thank you we will now

read the resolutions as we typically do and we'll start with the day of the teacher i'll go ahead and start whereas education is the most vital activity that we as a society undertake to ensure the well-being of the nation and whereas education is in large measure the result of the talent and commitment of teachers and thank you whereas teaching is a professional profession characterized by skill knowledge discipline tenacity and creativity in the delivery of instruction and whereas teachers are a source of caring concern counseling empathy warmth and love and whereas teachers deserve widespread recognition and gratitude for their performance and whereas teachers at the carlsbad unified school district exemplify all of these qualities and whereas teachers at the carlsbad unified school district educate and motivate students who have not succeeded in other educational settings or

have special needs that require unique skills and compassion therefore be resolved that the carlsbad unified school district board of trustees and the carlsbad unified school district superintendent joined with the governor and the state legislature in declaring may 11 2022 as the day of the teacher and be it further resolved that the carlsbad unified school district this 13th day of april 2022 hereby passed and adopted resolution number 34-2122 by the following vote for fortune or to nothing four to zero ms rollins resolution number three five two one two two classified school classified school employee week whereas classified employees are classified employees serve the people of the city of carlsbad through their work at the carlsbad unified school district and whereas classified employees continually assist the carlsbad unified school district in its commitment to provide quality educational

programs and services to the children of carlsbad and whereas classified employees individually and collectively set an exemplary standard of performance and commitment and whereas classified employees provide knowledge skills and expertise that are relied upon by staff throughout the organization and whereas classified classified and classified employees serve a vital role in providing for the welfare and safety of carlsbad unified school district students therefore be it resolved that the carlsbad unified school district board of trustees and the carlsbad unified school district superintendent expressed their gratitude and commend all classified employees for their service to the carls carlsbad unified school district and join the california state legislature in designating the week of may 15 through may 21st 2022 as classified school employee week be it further resolved at the carlsbad unified school district this 13th day of april

0902022 hereby passed and adopted resolution number 35212 by a 4-0 vote thank you very much we now move to item 7.7 public participation logistics trustees this is a discussion action item i turn it over to dr churchill thank you trustees at the november 17th 2021 board meeting trustee williamson requested that staff bring draft language about public participation to the december meeting in advance of returning to in-person meetings at the december 15th board meeting staff presented proposed updates to procedures for public participation at board meetings after review and discussion trustees made recommendations for revision to be brought back for approval at the january 19th 2022 meeting trustees approved updated procedures for public participation of board meetings in addition to continuing to live stream all regular meetings on youtube for real-time or future viewing trustees approved two

ways for public comment to be provided in person or via telephone the call-in feature was implemented at our first in-person board meeting on march 9th and again at our in-person study session on march 23rd it's important to note that members of the public have multiple opportunities to provide feedback to the board in addition to speaking at board meetings it's also important to note that we remain committed to live streaming our meetings for real-time and on-demand viewing at the december and january board meetings it was suggested that the call-in feature would be a temporary solution to pandemic related to a pandemic related problem namely that some members of the public might not want to attend a public meeting while covid 19 case rates were high as case rates are currently much lower staff now recommends that

we return to our original practice of in-person public comments at all board meetings discontinuing the practice of allowing collins beginning in may thank you thank you dr churchill are there any questions mr rawlings thank you and um thank you for answering my questions in advance but i did one did come up um later on and um if a member of the public requested that their email or written correspondence be read aloud at a meeting would the board have to honor that or would that go by a vote or would that not be appropriate um i haven't run into that so i think we'd have to take it on a case-by-case basis you're saying if a member of a public email to trustee individually and asked could you read this no in lieu of let's say

they don't want to or they can't come to the public meeting but they want to make sure that they're not just received the emails received but actually read aloud at a board meeting i'd defer a direction from the board on that but i i wouldn't recommend changing our practice my question is what is the practice in that if somebody emailed and said they wanted it read aloud what is the practice currently uh i'd respond and say thank you i'll make sure that the trustees receive it via email but you would not read it aloud no thank you ms rose so for people who are unable to particularly be able to access the meeting in person or are unable to come for the allotted time is there any way for their concerns to be heard by

the trustees as well as the public by the trustees absolutely so assuming that our board meetings are designed to accomplish the business of the board any item that in members of the public wish to send to the board in advance via email correspondence folks are available by phone members of the public bump into us at the grocery store regularly there's multiple opportunities for for those conversations and discussion um the the point of public comment is not to provide um a comment to members of the public rather it's for members of the public to provide comment to the board and so if they couldn't come it's correct that the best way for them then to get their opinions and thoughts suggested to the board would be via email miss williams if anything does change in terms

of covet increases and other other requirements are needed in terms of masks and or no audience are we going to bring back my my initial response will be let's wait and see what happens if if covet increases again there may be any number of mitigations that we need to bring back and and we'd approach that in the same vein another follow-up to the email reading aloud question prior to closed session for instance you had read trustee williamson you had read a an email aloud if any trustee wanted to do that based on a certain piece or an item on the agenda would they be able to do that or would it need would it take three votes in order to do that or how could we since we're changing the policy is there a method

if a a member of the trust member of the board of trustees wanted to read a comment aloud uh so i think probably this is better for board discussion amongst each other yeah yeah i guess i was asking the president that question it wasn't necessarily for you it's been hard for me not to speak because i have a couple of thoughts on that but we really are asking the staff but let's go ahead and go with it we have had in the past members of the public who were not able to attend give a neighbor or a friend their speech and ask them to come and address the board that has happened a handful of times so that that's also an avenue that's available and if you notice that what i read which was an

excerpt from one of our teachers he read it was before the meeting started i hadn't called the meeting to order yet because it would not have been appropriate once the meeting had started i just took the prerogative i had a microphone and and so i and so i i started it so that we would have to change our board practice if we if we did that once the meeting had started you've answered my question thank you okay mr pearson so i wanted to follow this same line of questioning saying if we wanted to change a board policy to include an element that we wanted to have the person who could not attend uh have be read their their email read that would be in a closed session that be a discussion in a closed session

where will the discussion be and when when the board policy would it be an agendaized item yeah so if we um have desire to make change to board policy or or board bylaw um uh uh if it's not one that staff is recommending at right regular intervals to bring forward any member of the public or board member may request that a policy be reviewed so so you could ask that that be placed on a future board agenda and the president and superintendent determine first whether or not a request is within the subject matter purview of the board of trustees and if so then they determine the best time to agendize that any further questions okay and now is the time for public comment and we do not have any callers online or blue cards for

this item may i have a motion to discontinue the practice of allowing collins for public comment at board meetings beginning may 1st 2022 so move williams second pearson trustee williams made the motion trustee pearson seconded the motion discussion i was not clear whether excuse me before i was going to vote in favor of this or not um and but i did have a conversation with staff and that convinced me to vote in favor of the recommendation however if it did come to um to me because i did not hear you say that it's a actually a policy that's actually a practice so i would if it did if an email came to me or somebody wanted their email to be read i would be making that request to the board to read that aloud um

because it's a practice and it but as we saw tonight there weren't many colors and i do believe that uh folks calling in is starting to wane anyway so i will be voting in favor um and uh but if a member of the public did want an email read i would do my best to be able to read it aloud at the board meeting ms rose so i know my vote isn't official um but i would be voting no and i would urge you guys to do the same in terms of i believe that it decreases accessibility of members to the board i understand where you're coming from of that we can that you guys can be emailed run into in grocery stores but all of that requires the public to be aware of these

practices and to know and access this information freely additionally i would argue that it decreases the transparency of the board to the public as uh the public isn't able to hear what we are hearing and thus are unable to communicate against each other as well thank you and thank you for speaking up we appreciate we always appreciate hearing from our student rep ms williams so initially i was i was on the fence in terms of um being against it or for it but our prior practice pre-covered was that speakers needed to attend and then the the the actual meetings were not even live streamed so post now during covid it was online live stream and call in so now we're kind of going back to post covid not postcode we're going back to where we

were at precovid but we are still having that opportunity that we're live streaming so we're continuing that which is a plus and we're slowly going back to our previous practice so i will be voting for it okay thank you miss garcia oh mr president i'm moving along you need to thank you president you're moving along um but i do want to make a comment uh the one thing i observed during covet in terms of call-in was that i think one of our trustees had pointed out that we had a lot of volume people calling in to do that and participating but i also recognize that it's based on what the subject matter is at the time and so tonight was a good example of staff showing up for a lot because there was a circumstance

issue that was important to them now to our teachers and to our classified employees as well too so i would i would hope that you know we keep this dialogue with the community that they are satisfied with the way they can communicate with us in a transparent way which i would agree with the student representative on on the transparency conversation thank you and i will be voting in favor thank you ms garcia would you please call for a vote student daylen no trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes motion passes 4-0 thank you and thank you dr churchill for the presentation thank you we now move to item 7.8 williams uniform complaint procedures trustees this is an information discussion item i'll now turn it over to dr churchill thank you

at the march 23rd meeting of the board of trustees a request was made for staff to provide additional info to the board as an agenda item about the williams complaint process and follow up with info to all stakeholders california education code section 35186 known as the williams settlement legislation creates a procedure for the filing of complaints concerning three areas deficiencies related to instructional materials if someone can wave their arms the lights will go back on conditions of facilities that are not maintained in a safe or clean manner or in good repair and teacher vacancy or misassignment districts must submit a quarterly report to the county superintendent and the district's board of trustees on the nature and resolution of complaints addressing insufficient instructional materials teacher vacancies misassignments and emergency or urgent facilities issues the summaries must

be publicly reported on a quarterly basis at a regularly scheduled meeting of the board of trustees tonight for example we provided this information in consent calendar item 6.9 covering the quarter of january 2022 to march 2022 administrative regulation 1312.4 describes the williams complaint process in more detail a link to this ar is included in the student handbook which is distributed to all parents annually in your board packet tonight exhibit a includes a copy of the williams uniform complaint procedures form this form is available on the district website in school offices and in the district office exhibit b includes the williams complaint classroom notice which is to be displayed in every classroom it did come to our attention that the notice was not posted as required in 100 of our classrooms particularly in newly constructed or

renovated rooms we are remedying the situation our team met with all k-12 administrators yesterday and principals will ensure that we are compliant with the posting requirement moving forward assistant superintendent dill and director cronky will ensure that the williams form is posted in every classroom as part of the custodial team's updated annual summer checklist happy to answer any questions any questions ms rollins so i did submit some questions in advance and i appreciate you answering them but i do have follow-up questions on that so in reading um ar 1 3 1 2.4 um it does or at least um maybe you could point it out to me where it states that the complaint needs to be on the particular form in order to rise to a williams complaint it does not and in fact the the

the regulation and the head code is clear that we'll still accept a williams complaint on any form it doesn't have to be on that form we provide the form for clarity and and to help uh parents and community members understand what is covered by the williams complaint but you could scroll it on the back of a napkin and we would uh be obligated to respond my next question is does it have to be in writing i'll defer to my colleagues i think so i don't i don't know yeah they're all saying yes yes it needs to be in writing but it could be anonymous as well so it doesn't have to have a name attached to it but something in writing uh needs to happen in order for the complaint to be filed so i

just want to be clear because for my for my brain it could be in writing could be on a napkin but so long as it's in writing and it falls in these categories but if it's verbal and it falls within these categories it would not be considered a williams complaint even if it falls in the category correct i think that's correct yeah and i you know before i speak i i would just want to get a legal opinion on that as well i i i every uniform complaint and williams complaint that i've received to date has been in writing um i don't believe we've had anything traditionally what would happen if somebody brings something to me or or a principal site principal we'd ask that person to put that complaint in writing regardless but i

don't i don't know definitively if if a verbal complaint is uh issued to a principal whether or not that would suffice as a complaint what i would say is that the purpose of putting it in writing is to document that the the complaint has been submitted and it starts the timeline for the response um it also gives the person receiving the complaint a basis of of to investigate where you know they can look at this see this is what was relayed to me or to other people that i'm now reviewing and now i need to go through and factually verify you know that these things did or did not happen as opposed to a verbal complaint which could be you know a lot more more vague so you know the the written format it really

assists with the documentation and the investigation of the complaint i would just also add that it is incumbent upon the district to provide assistance if somebody is incapable of putting their complaint in writing either through a language issue or for for any other matter it's incumbent upon us to assist them in condensing it to writing any other questions like i said now and thank you all for answering for chiming in on that one and then the next piece is that once it's received and then investigated it's supposed to be investigated or at least come to a conclusion and then there's supposed to be notification would if it's not in writing does that mean that there's the notification to parents that this is occurring wouldn't happen well the notification is intended to the complainant so as

dr and i said you can submit a williams complaint anonymously and and our form specifies that that's okay but then there's no way for us to respond to let you know what happened if you include your contact information then then uh the ed code is clear that you have 30 days to resolve the complaint and 45 days to uh respond to the complainant if you have their information and just to clarify because i think i misread the piece it i thought it stated that there you needed to notify the the community that was impacted by the subject of the complaint i don't know if you could quote that specific section i i i dr and i maybe if you correct me if i'm wrong but that would be uh say if illegal fees were charged

uh we would have a duty to inform anyone who uh who did pay those fees uh and proactively refund them of that but most of the types of complaints that are williams related are you know discrimination or teacher miss assignment and it would be unique to that individual and not a community and and legal um you know illegal fees don't fall under williams it falls under a uniform complaint a different board policy okay now is the time for public comment we'll hear from callers first ms garcia we do not have any callers on the line and there are no blue cards for this item all right we will now move on to governance team reports and requests we'll start with ms rawlings we're starting with reports and thank you this is a report from our

wellness committee that met on march 18th unfortunately trustee williams was unable to attend so i was there to represent the board and we've had some of these conversations um already as part of our lcap and we actually some of the items were discussed and placed in the lcap as a result of our meeting so i'm not going to go over everything but dr nye has said that he will ensure that the report is available to the board um uh very soon and from he took notes one of the things i know that has been discussed is styrofoam trays and the styrot foam trays we are in the process of looking for compostable flat trays to replace those as well we also have discussed in our meetings but i'm happy to say that that we do

have an rfp out for a locally sourced fresh produce for our students and we also are looking at sustainable cutlery bamboo options one of the things that is occurring as a result of our meeting i believe is a notice to students that two notices one that they can ask for plastic single-use plastic items that they can also bring their own and it's actually being posted at our secondary sites and that they also dietary choices including vegan options will be available and the information will be distributed to parents and students as well and one of the things that was brought up around mental health services is how appreciative the the elementary counselors have been and how much they truly believe that it's helping the learning and behavioral issues at the school sites and they were they're

very thankful that we are hoping to continue that through our lcap as well and recycling has resumed and is at all of our sites which was something that is near and dear to my heart and that is continuing um now that we are back from covet and there's other items that are contained here that you can read as we move forward thank you thank you for that report ms williams thank you last thursday after a one-year hiatus due to covid we had our ninth annual cope of the carlsbad soccer tournament where all cusd elementary schools were invited to participate in a district-wide soccer tournament one boys and one girls team represents each elementary school it was a great community fun competitive successful event we had lots of parents grandparents teachers principals out there and other

students attended attended to cheer on their schools the referees were the seniors who participated when they were in fifth grade in 2014 so i would like to congratulate avr oaks elementary girls team and kelly elementary boys team for winning thank you very good thank you are there any requests by the board there is a need to return to closed sessions so we will do that now and we will not be reporting out and if there are any oranges or lemons or cookies left over there you're free to take them home with you you
