001okay good evening it's 605 pm and the board is reconvening from closed session the board took action in closed session to reject claim number 22-05605 by a vote of 5-0 welcome to the public board members and staff thank you for attending it's good to see you in person it's been several months since we've met in person and because there may be some people here tonight who are attending their first board meeting i'm going to take a few minutes to make sure that everyone understands the expectations of the meeting and to explain some new logistics school board meetings are business meetings that are conducted in public they are not town hall meetings where there is an ongoing discussion between board members and the public although the brown act allows for public input as a school board

002we have a responsibility to ensure that the agendized business of the district is completed during the meeting we will be following board bylaw 93-23 and the brown act for all public comments in order to allow speakers to present their comments and ensure that we're able to properly attend to the business of the board public comments will be listed limited to 20 minutes per item including oral communications depending on the number of people wishing to speak to each item each speaker will have up to three minutes in an effort to hear as many speakers as possible comment times may be shortened depending on the number of comments received if there are more than 20 they could be shortened to one minute if there are up to if there are 20 speakers if there are more than

00320 those individuals who were not given the opportunity to speak will be given the opportunity to address the board later in the agenda tonight we will be accepting comments both on via phone and in person in order to let speakers know how much time they will have in case they need to modify their planned remarks due to a shortened time virtual listeners must press star 9 as soon as i announce announce the agenda item those attending in person who wish to comment on a specific item please turn your blue slip in now if you haven't already done so however we will accept them up until that specific agenda item is announced there will then be a brief pause while we determine the number of speakers and i'll announce how much time each speaker will have

004we'll then listen to the staff presentation then board questions and then have public comment we hope this change in process will give those who wish to comment time to adjust their comments if necessary if there are 20 or fewer individuals who indicate they wish to comment we'll hear we'll hear all the phone callers first and then the in-person speakers if there are more than 20 we'll hear from the phone callers for 10 minutes and then in-person speakers for 10 and the remaining speakers both call in and in person will be given time later in the meeting if you wish to speak about something under our purview that's not on tonight's agenda please indicate oral communications on the blue card otherwise indicate the agenda item to which you wish to comment a timer will appear on

005this screen so you'll know how much time you have for phone callers when your time is up the call is disconnected for in-person commenters your microphone will be turned off once your time expires so please complete your sentence and move away from the podium to allow the next speaker to begin and as a reminder a speaker may not yield time to another speaker please be respectful of others in attendance please show your support or agreement with the speaker i just turned off my mic wave your fingers if you support the speaker if you disagree with the speaker please remain silent please refrain from whistling clapping cheering or booing because loud boisterous and unruly behavior interferes with the ability of the board to conduct the school's business following two warnings those engaging in disruptive behavior will

006be asked to leave if necessary i may order the room cleared or we may relocate to another room please wait to come to the code podium until you are called just one person is admitted at the podium at a time an exception is made of a young student which wishes to speak and needs some adult support those who have been called to speak next are encouraged to wait over at the side please be sensitive to those who wish to social distance by not congregating in doorways or aisles it is our desire to preserve the public's right to participate and observe the public's business while meeting our obligation to carry out the district's business thank you in advance for for respecting these legal standards we'll begin tonight's meeting by trustee pearson leading us in the pledge

007of allegiance that will be followed by trustee rawlings leading us in a moment of meditation trustee williams reading from the district vision and ms garcia will then take roll call before we load our flag of freedom i'd just like to acknowledge the ukrainians fighting for their survival and sovereignty and i hope we can think about ukrainians in our own personal way ready begin i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice for all and i would also like us to take a moment of silence to um think about the ukrainian people and all people in war zones at this time thank you i will read from the district vision our students are engaged self-directed learners

008they are exposed to different learning environments and pathways students aspire to expand their talents and achieve excellence they are good thinkers communicators and problem solvers okay we'll now take roll trustee jones here trustee williams here trustee rawlings here trustee pearson here trustee williamson here thank you trustees may i have approval for agenda item 4.1 approval and or reorganizing reorganization of the march 8 2022 meeting agenda so jones second rawlings trustee jones made the motion and trustee rollins seconded ms garcia please take a vote trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes motion passes our student representative is unable to attend tonight so we will move now to the superintendent's report dr churchill thank you trustee williamson our students today are connected to the rest of the world in

009ways that when we were kids seemed unimaginable while this is a very good thing when it comes to understanding our individual and collective impact on the world it also means that our students are more exposed to world events than ever before and more directly impacted by events happening halfway around the globe here in carlsbad a number of our families students and staff members have personal connections to ukraine and russia understandably the situation unfolding there may directly impact our students and their family members this is a good moment to remind our board and community that our counselors psychologists and other school staff are ready and available to provide additional resources to any of our students and staff who need additional support parents and students whether it's due to world events or something closer to home please

010reach out directly to a staff member if you're struggling or in need of support thank you dr churchill we now move to oral communications per education code 35145.5 members of the public have the opportunity to address the board on any item of interest to the public that is within the jurisdiction of this of the board we'll hear from callers first followed by blue cards from the audience ms garcia if any caller wishes to provide public comment on non-agenda items press star 9 to indicate you wish to speak we have one caller who have indicated they'd like to speak and four blue cards whoever that have been received for a total of five each each individual will be allowed three minutes to speak speakers are asked to state their name and indicate whether or not they

014order and the time will be if you can see the time will be up on the large screen on this stage is this on yes okay i can hear you thank you thank you i'm kelly laberthon carlsbad resident a carlsbad parent recently posed this question now that we received permission to let kids breathe again what's going to be the next battle in fixing our public education the list is huge one battle worth fighting is for the right of parents to raise their children and to make medical decisions for them this battle is not only being fought over masks and covid vaccinations but in what our schools are teaching our children by now everyone has heard of critical race theory which purports to be caring and inclusive but is in fact hateful and divisive crt is

015already in our carlsbad schools for example the equity training at sage creek high school last september titled systems of oppression led by dr dorsey the same dr dorsey with whom our trustees want to contract contract in their upcoming three-year cultural plan they train students and teachers to break down their identities into race gender class sexual identity masked and unmasked vaxxed and unvaxed oops no those aren't in there yet but they are coming too because the whole point of this exercise is to divide us into these different identities so the state can know who is obedient to their control slide four of the presentation states that understand how history of education in america is shaped by systemic re oppression understand the implications of systemic oppression on our current educational system dr dorsey also trains in the

016wheel of power and privilege it is entirely devoted to skin color and identities specifically noting that if you are quote dark skinned undocumented you are marginalized dr dorsey trains that our skin color does matter and we must all engage in viewing every experience through the prism of race and the many identities they put on the power wheel this is the divisive nature of the pedagogy of critical race theory viewing everything through the prism of race skin color and identities recently poway usd rejected dr dorsey and the wheel of power and had it pulled from the schools while there are indeed many worthy items to fight for stopping the political indoctrination and the race to the bottom of academic achievement for our children because they are being politically indoctrinated instead of learning math science and literature

017has got to be at the top of the list mr davidson please uh come to the podium state your name and indicate whether you're or not you live within the district boundaries we're trying to get the clock um back up there i'll i'll set my own timer right thank you uh dear trustees and superintendent churchill my name is scott davison and i am the parent of a child at cusd this has been a difficult month for many parents students teachers and staff in cusd while we saw school districts around the state and here in san diego changed their policies in line with the lifting of the statewide mass mandate for adults and stop excluding students who choose not to wear masks this board took no action when it became clear that not only was the

018shift in enforcement legal but allowed by both cdph and sd county health this board took no action instead dozens of students spent weeks sitting outside sometimes in the cold and rain removed from their classrooms in a peaceful protest of the continued hypocrisy of our state and local leaders when it comes to coveted policies that always seem to punish children instead of adults instead of supporting these students they were harassed and ignored marked as unexcused absences and continuously prevented from doing their schoolwork this created further conflict among staff and administrators who had been written up or had their teaching credentials threatened for not strictly enforcing cusd's decision to exclude students instead of attempting to resolve these conflicts cusd administrators and this board sat by and watched the conflict permanently damage relationships between students parents teachers and

019administrators we watched last year as the school reopening debate created permanent rifts in this community that may never heal they may never heal because there has been zero accountability from this board for the decisions to keep our schools closed and force our students into indefinite remote learning not not once has anyone on this board acknowledge that school closures were a mistake or let alone offer an apology to the students and the families who are harmed by these closures instead this school year and particularly this past month has demonstrated this board has not learned to listen to opposing viewpoints or attempt to resolve differences in favor of our students this board is infamous for its inability to respond to or engage with concerned parents and then it wonders why meetings are filled with anger now that

020our children are finally able to remove the most visible sign of the pandemic this board has another opportunity to acknowledge the mistakes that were made and push our district toward a true return to normal the question is will you take the opportunity to continue or continue to allow our school community to become further divided and if you're again unwilling perhaps it's time for us to find some board members who are thank you shauna hurst and then crystal walter i'm shauna hurst i am a member i have two kids here at calavera middle and it's like my fourth time in the gym and i'm so excited and i'm just here because i miss seeing you guys in person so i just wanted to say i'm glad we're here i'm glad my sixth grader is at camp

021i went on a field trip paid for by cef yesterday to the lagoon and all parents who've been to the lagoon for third grade my seventh grader actually liked it so not that it's about a third grade but we do go three times so i just wanted to be i know there's a lot of issues i bring them up at psac and many other ways with you but tonight i wanted to focus on the positive that we're here we had a great honor roll breakfast i am the ptsa president here we had 400 kids right outside there we had lots of chick-fil-a sand breakfast sandwiches and donuts from albertsons and both of those partners gave us great discount so we appreciate our community support so i'm just glad we're back in person i'm glad my

022kids will not be wearing a mask on monday and it's just i'm glad to be here good to see you all and i'll see i hear we're going to have an in-person peace act too thank you krishna walter okay hi i'm not good at speaking but i'm going to give it a go excuse me could you get a little bit closer to the microphone speak a little bit better i'm here to talk about the indoctrination of our kids in carlsbad unified school district teaching children to solely look at one skin color determine if they will oppress or be oppressed is a criminal act and moves our society back to a dark time in our history where people were judged but not by the content of their character but by the color of their skin dr

023dorsey's training is filled with critical race principles you only need to look at the wheel of power and privilege to see it's entire entirely devoted to skin color and identities teaching critical race theory to children is divide div dive oh i can't say that word divisive in nature by viewing everything through a prism of race skin color and identities this will only do harm to the children in the carlsbad unified school district and should not be tolerated by teachers staff and other parents alike as disturbing as it is to teach our children to discriminate it is equally or more so disturbing to teach them about communist principles equity and is not equality equity is about ensuring that every i'm sorry equality is about ensuring that every individual has an opport equal opportunity to make the

024most of their lives and talents equity is a is about bringing everyone down to the lowest common denominator so that all kids will start at the same place equity is a fundamental principle of communism i'm not sure if the board is aware but teaching communism is against california education code article 4. i handed you that flyer it's under title 2 article 4. a no teacher given giving instructions to any school or on any property belonging to any agency including the public school system shall advocate or teach communism with the intent to indoctrinate or inculate in the mind of any pupil a preference for communism you can read the rest on your own um in closing dr darcy's can say he isn't teaching critical race but if you just look through his training it is clear

025he embraces the critical critical race teachings and the board needs to put a stop to these marxist divisive and in human humanizing practice now thank you so much thank you we now move to item 6.1 the approval of the consent calendar all matters listed on the consent calendar are considered by the board to be routine and will be enacted by the board in one motion there will be no discussion on these items prior to the time the board will vote on the motion unless members of the board staff or public request specific items to be discussed and or removed the consent calendar now is the time for public comment we'll hear collar from callers first followed by blue cards ms garcia are there any callers if any callers wish to provide public comment on this

026item press star 9 to indicate you wish to speak we have no callers that have indicated they'd like to speak and we have no blue cards for this item trustee williams has asked that we pull items six point three and 6.4 are there any additional items to be pulled now i have a motion to approve the consent calendar with the exception of items 6.3 and 6.4 so move pearson trustee pearson made the motion trustee jones seconded the motion ms garcia please call for a vote trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes motion passes unanimously may i have a motion sorry yes thank you may i have a motion to approve item 6.3 and 6.4 so move jones second rolling trustee jones made the motion trustee rawlings seconded

027the motion trustee williams do you want to speak on this matter yes so i pulled item 6.3 and 6.4 from consent because i will be abstaining from voting on this item city of carlsbad and miracosta community college district are both listed on the p are listed on the po register and the ap warrant listing my company works for both of the organizations while no material conflict of interest exists out of abundance of caution i want to avoid the perception of a conflict of interest thank you ms garcia please call for a vote trustee jones yes trustee williams epstein trustee rawlings yes trustee pearson yes trustee williamson yes motion passes foreign favor one abstention thank you we now move to our discussion action items item 7.1 hope elementary water remediation is an information discussion item i

028would like to begin by reading a statement under agenda item 2.4 members of the carlsbad unified school district board of trustees met in closed session tonight available that occurred at hope elementary school we deeply regret that intermittent water related complaints and investigative efforts did not result in the cross connection being discovered sooner we understand your concerns and we empathize we are confident that in the coming weeks our staff will provide the board and the hope community with the following information one how did the cross connection occur two what complaints were received and how were they addressed three what are the potential health implications for our students and staff who may have been exposed to cross-connected and potentially contaminated water and four what changes will be made to ensure this will never happen again there will

029be some hard conversations at this time we're not going to speculate on possible outcomes we're going to wait for all the facts and then carefully consider the changes that staff recommends clearly mistakes were made and we must learn from those mistakes district staff and all of the district's contractual partners must understand that having safe water air and soil at each of our sites is non-negotiable i close by expressing appreciation to those who quickly resolved the issue once it was determined that a cross connection had occurred i'll now turn this item over to mr dill thank you president williamson and let me begin by affirming uh the apologies and regret that you expressed on behalf of the district this is an unfortunate an unfortunate situation and please know if we had been aware or suspected that

030the cross connection with the reclaimed water system was the cause of those intermittent complaints that we received we would have corrected that immediately as we did on on february 24th throughout as concerns were reported to the construction team the information that we received back is that the water had been tested and that it was safe to drink we know now that the type of testing that was performed was just looking for the biological contamination and that came back negative each time because the reclaimed water is treated to remove those substances the cross connection does appear to have occurred during the course of construction based off of the timing of the of the complaints and the proximity to where we located it to where other work was performed during construction but at this point our investigation

031is still ongoing as to how the connection was made and by whom it's too early to discuss that information until we have absolute certainty uh on on how and and whom that connection made that connection we know that a routine test by the county of san diego in 2018 did not show any evidence of a cross connection so we do have some some past history i will point out that the campus is served by multiple points of connection to the potable water system so the cross connection was not the only source of water coming into into the campus also in the classrooms the drinking fountains had been turned off as a as a covid protection and so we but we did have the filtered water stations outdoors which were operable as as we reported the

032first instances were noted after the school reopened the lines were flushed and the problem appeared to resolve further reports uh occurred in november and the construction team was sent out and to investigate and additional water samples were taken and we were relying on the information that they provided us you know once again that they had looked into the problem and had tested it and did not find a problem another test in january came to us the results were reported to us in february and that showed the particulate matter but it still did not come back with any other biological contamination and that was the point when we engaged an outside party to assist us in the investigation as the construction team was unable to resolve that problem and that's what led to that discovery on

033february 24th we posted copies in our frequently asked questions of the five reports that we have of the water quality testing the january reports the the most informative as to the profile of the water when the when the discovery was made the water was immediately shut off until we could locate that point of connection we did discover it disconnected it and the process began to purge the system of the of the cross-contaminated water and that was done under the direction of the city of carlsbad and their crews and and we thank them for all of their support during this process to to assist us uh the city was also in communication with the county of san diego department of environmental health they also were in uh communication with the state water resources control board those

034agencies did review our communications that we made to the public prior to us making that and they did they did ask that we advise parents to consult their physician if their children had any stomach or intestinal problems our immediate focus was to restore the potable water system at hope which we did again thanks to the assistance of the city of carlsbad since then we've been doing other exploratory work on the campus to ensure that there are no other potential cross connections the reclaimed water has been off since february 24th so it is currently not operating uh and will not be re-energized until we have a very specific process with the county of san diego uh which would include cross-connection testing going forward we do not i'm sorry we do have reclaimed water at some of

035our schools but not all of them obviously as we move forward on any of our construction projects that do have the reclaimed water we are going to require cross-connection testing on any project that involves either the potable or irrigation system we do have mechanisms in place to report environmental health and safety concerns the first step is always to report the problem to the school or the principal in this case ms rossiter did contact the construction team when the complaints arose and that's how they went out and and investigated and completed those tests um we both miss rossiter and the district we relied on those reports uh and and relied on the expertise that those uh construction professionals had in their industry if problems cannot be handled immediately any facility condition that poses an emergency or

036urgent threat to the health and safety of pupils or staff may be reported in writing using the uniform complaint procedure under the williams act and that is posted the rights of parents and students and teachers are posted in every classroom and we include that in the annual notification the williams complaints are summarized in a quarterly report to the board and it does require a written response back to the person making the complaint and it's subject to review by the california department of education so you know if we were to ever have any type of environmental quality issue of any nature at any of our schools that williams process could be availed by any person in order to trigger a higher level response if it was not resolved immediately or to the satisfaction of the person

037making the complaint and and finally you know just to reiterate uh president williamson's uh comments we are gathering the information that she asked that we uh ultimately will report back to the board and to the hope community and we are gathering that information and want to make sure that we are and completely accurate and uh we will continue to communicate the information that we have as we have it thank you miss garcia would you please call for uh to see if there are any phone-in comments and so we'll just put a pause before we ask questions if any caller wishes to provide public comment on this item press star 9 to indicate you wish to speak we do not have any callers that would like to speak and we have eight blue cards that have

038been received for a total of eight comments so uh the eight speakers will have about uh can we do two and a half minutes is that possible yes we can we did someone did just raise their hand so there's one okay so so uh we'll have the speakers will have two and a half minutes each once we have had the staff the board questions thank you all right board members are there any questions for mr dill or for dr churchill ms jones mr dill you indicated that uh in your comments that 2018 testing was done by the county was this the only cross-connection testing that occurred that we're aware of that's the only one that i'm aware of at this time the county did tell us that they thought they had one from 2019 uh

039but we only have the 2018 at this time so we're continuing to research i have additional questions about you my next question is will additional testing be performed once reclaimed water is turned back on at a time when students and staff won't be on campus to ensure its safety yes that's the standard is that you would you would conduct that uh you would re-energize that system outside of school hours and conduct the the cross-connection testing under the supervision of the county of san diego okay and then i have a follow up on that is it a follow-up to that if or is it a new question because ms rawlings has a question i just wanted to reaffirm the the type of testing go ahead okay well the testing that's performed will include both sets of

040tests because it sounded like there were other tests performed later will both sets batteries of tests be performed yes so that that is what the the county supervises when you enter re-energize a reclaimed system um they are specifically looking for any issues of cross-connection and will those results be communicated as have been so far yes we can get those results yes does that work hello okay um and mr dale thank you very much for answering my multiple questions prior to the meeting um but i did want to ask about the testing um is the county of san diego the only entity that actually does this type of testing when it comes to construction or is that just a routine testing no that that is now mine's off i think uh that is specific no it's

041okay is it nope it's not when you are energizing the system that would be under the supervision of the county but routine testing could happen at any time what is the entity that's responsible for testing um before and after construction or is there an entity that's responsible for that yeah the so the the testing that was done um which was looking for the biological was typical of when you're just doing a standard con construction project and since they had not they did not believe they had touched the irrigation system they did not con conduct a cross-contamination test that would have been our our plumbing contractors the plumbing contractors did that testing correct it said that there's no other testing that occurs during construction correct got it thank you are there any further questions all right

042we will now go to our comments oh i'm sorry who oh miss jones yes thank you so mr dill you mentioned that the partner organizations receive the communication will they also be and this is san diego county health department and the water board will they also have an opportunity to review the tests to understand the levels that are indicated on the test results that we have well if if we were to re-energize that system again it would be under their permitting process and so they they're the ones that would ultimately give us the permission to operate it once again so they would have to review that and give us the okay so communication and test results we're going to take a brief recess so we can see if we can get the microphone fixed is

043working i apologize for my microphone errors trustee jones was asking questions as to whether when we get to the point when we are ready to re-energize the reclaimed water system at the school if the the city and the county would be conducting cross-connection testing to make sure that it that the systems are not cross-connected and would they have would they be reviewing the results of tests and since we do that under their permission and they ultimately review that information and give us the permission to operate they would have to review that and then give us the go ahead to say yes we're clear to to restore that service back to the campus thank you did that cover the questions i just want to make sure we started at the point where ms rawlins did you

044have a question also that he had answered when the microphone was off i think i cut out just as ms rawlings was asking questions yeah i'll repeat my question my question was um are there what entities would be responsible for testing the water during construction and you had said that that's not the county that it's actually that the testing occurred with the uh the plumbing contractor um but there's no requirement or no testing that traditionally occurs for construction correct board members are there any other additional questions okay now one more question oh we can't hear you either hello yes in the audience if you can hear her via the microphone would you please indicate test yours is not working either can you hear me [Music] going to it's going to rip out from the source

045mr joe my question was the test results that the that the plumbing construction company performed had those then provided to authorities for review as well san diego county health water and so on those would not have been because they the the city and the county would only be interested in a cross connection test and that was not done at the beginning of the school year that was just a routine test to make sure when they reopened the campus that um you know that there had not been any biological contamination that resulted during the construction that's not typically provided to the city or the county okay thank you see no further questions now is the time for public comment we'll hear from callers first we hope we can hear followed by the blue cards from the

046from the audience ms garcia speakers are asked to state their name and indicate whether or not they live within the boundaries of the school district when we call the last four digits of your phone number press star six to unmute you will have are we doing three minutes you will have two minutes we will have the timer on the screen and we'll mute your mic when your time has expired the first caller is 7509 press star 6 to unmute caller press star 6 to unmute hello hello we can hear you go ahead okay my name is stacy bruce and i am a resident here in carlsbad unified school district i could ask you many of the questions that everyone else is posing regarding the cross water lines at hope but i won't i am going

047to speak about the division between the administrators in our district and the parents who have placed their trust in you to keep them safe and provide a healthy environment the lack of communication and empathy from the administration has not been the greatest for the last few years but now it is abysmal i have not gotten the sense that anyone in the district off office cares that the hope children and staff have been drinking non-potable water for at least six months in the little communication that has come out there is no empathy and no sense of unification and finding answers to all of our questions i understand that you may not have all the answers right now but please tell us what you do know and what you are still trying to find answers to i

048think the administration needs to take a lesson out of the stanford harmony social and emotional learning program that has been used with the third grade hope kids regarding conflict resolution there are three types of personality models a conflict controller a solution finder and a conflict avoider all i am seeing right now is the district's trying to control and avoid the conflict and not find a solution alongside the parents stanford harmony has four steps to solving conflict stop staying and cool off talk it out think of ways to solve this problem and pick a solution and try it out if we expect our students to follow these steps our administration better do it too part of our ltap plan is to improve the social emotional well-being of the children in our district and to provide development

049opportunities and programs for our teachers we add one for our administrators for their own development opportunities and programs on how to show empathy and improve relationships and communication with the district community of parents and students thank you for your time thank you and our next caller is eight six two four please press star six to unmute caller 8624 please press star 6 to unmute hello my name is michael reichel and i'm a resident of cusd and i have a son at hope elementary who coincidentally the day that the students were sent home had stayed home originally because of intestinal issues and diarrhea we cannot hear you uh mr ladle because you so my son stayed home sick and then i found out later that all the kids were sent home so i don't know if

050that's a coin coincidence in fact there's a lot of things that i don't know when these these complaints came up and they decided to investigate no one was old i don't know why parents weren't alerted i told my son not to drink the water at schools and yet he was the whole time he told me that teachers told him at some point not to drink the yellow water although without his you know functioning of of the cerebral cortex of being able to remember that he's at recess he kept drinking it so i don't know why we weren't warned that there's some investigation from the very beginning and there wasn't transparency looking at all these tests i've been very concerned because they had such a myopic focus on just e coli the whole time when it's

051all the other contaminants i have a very good friend i just moved here from san francisco ironically to be in a better environment for my son which the wheel of fortune seemed to have landed in the wrong place because he's a cancer researcher and he told me how dangerous this is particularly with the kind of chemical contaminants that may have been ingested and his warning is that in his research when this kind of thing happens years go by when the kids are done growing and then the cancer would activate at that time 10 15 years later there's a lot of unknowns here but what i can see when i look at the reports and why the contractor was the one investigating their own errors beyond me why and i've heard that the city was unaware

052that there was permits to work on such a thing the water as we've called the water district it was doing we claimed water checks in our own neighborhood nearby for some reason and we just don't understand when you look at this report the phosphorus level for example is five times the federal law for what is acceptable and safe thank you we will now move to the blue cards when i when i call your name please come to the podium state your name and indicate whether or not you live within the boundaries of the school district because i had previously announced that you would have two and a half minutes we were going to have um two and a half minutes put up on the um on the timer uh once you your time has elapsed

053the microphone will be muted so please finish your sentence then we look i think i said two and a half i did and i meant to say two so i did the same things i did last meeting so i would like to because they were could have been preparing to cut it to two and a half let's do two and a half yes please sorry um [Music] i will go in the following order lila maro and sonia russo those will be the first four speakers please state your name and if you live in the district hello i'm lee lamarro could you put me you can put your face right next to the microphone so we can hear you thinking my apologies my name is lela morrow i am a sage creek high school student and

054a former hope student my mom is pta president and my little sister is at hope tonight i want to address my concern for students like my sister as well as former teachers and current i was really concerned when i heard about reclaimed water being mixed with drinking water for over six months and when this topic came up my sister told our family how she drank from the water from the beginning of the year seeing that this was yellow and it tasted bad in addition she mentioned to she mentioned how her teacher told the class i don't trust the water in yuchin either whilst she also offered bottled water to the class the whole entire year although we still don't know the lasting effects on those who have prolonged exposure to this drinking water i cannot

055thank enough the hope staff like my sister's teacher who have continued voice concerns being advocates for themselves and hope students to finally bring this issue to an end thank you for your time and i hope in the future that there will be more communication with our community when it comes to this health and safety of staff and students hello my name is kat morrow and i'm an 11-year parent at hope elementary school pta president and carlsbad unified employee tonight i want to address my concerns i had for students and staff i'd like to better understand why this water issue was prolonged at the risk of the health and safety of so many when students and staff complained over six months with five different tests taken and the most extensive one seeing seems to be on

056january 11th as a 17 page report i'd like to know based on the report at that time who made this decision to still allow staff and students to attend school continuing to clean even health instruments wash hands food to give an example our winter carnival we served hot chocolate to all of the attendees and it was from the sink water um without knowledge to our community i understand you could not find a cause but you waited 44 days later to test again why not bring in a second community to test again to see if more answers could be found second the hope community has not been given an opportunity to have an open conversation with board members and the construction management it would have been nice to have an open dialogue and fortunately at school

057board meetings we are given the opportunity to address our concerns speaking at you and not with you with a limited time frame to speak and it's been 14 days since this has happened thank you for your time i hope that there can be an in-person meeting at hope elementary school very soon to address our very concerned community thank you thank you good evening my name is carly paganis i reside in the district my daughters attend hope elementary unfortunately i'm not approved to go on to campus so i never experienced the disgusting water which is how my kids refer to it sorry once we were informed on friday february 25th of the contaminated drinking water my children told me how they thought it tasted like dirt and that teachers complained as well as you can imagine

058this was very upsetting to me as a parent to not have any knowledge of this until school was shut down the lack of communication and transparency transparency from the school and the district about the ongoing water tren um ongoing testing and funky water that seemed to be a common topic at school with the staff and students and here i was just learning about it this is unacceptable these are our children i sent my kids to school thinking they are safe and i feel you've failed us i want answers as do many parents if proper protocol was done with permits how did the city of carlsbad inspectors carlsbad unified construction director and contractors not do a cross connection check why wasn't a large panel of testing besides e coli done back in august or even last

059year when the construction started looking at the enviro matrix findings from january 11th the testing has spiked the the testing results had spiked with heavy metals why weren't parents informed then children should as my pediatrician said children should all every child should have a blood test panel completed and checked for long-term heavy metal damage that could go to the brain and including chlorine pharmaceutical drugs pesticides and who knows what else is in our reclaimed recycled water the school district should reimburse each parent that chooses to have their child's blood tested by rabies in addition any parent who has taken it upon themselves to have carlsbad reclaimed water tested to find out what harmful drugs and chemicals are in the reclaimed water should be reimbursed by cusd and cscusd should continuously have all school drinking water

060tested to ensure this never happens again i along with many other concerned parents deserve an open forum and answers to how you plan to address these issues and the health concern that may arise in the future i emailed each one of you on the board about this matter on february 27 and received no response except for mrs rossiter and i find that unacceptable as well thank you after miss rousseau we will have crystal jones chris davison kim mcconnell and then casey gosselia good evening my name is sonia rousseau i have two students in the khasbad united unified school district one in sixth grade and one in 10th grade and i'm a member of the cusd district i have one question i'd like to know what was the exact date of the incidents of contamination from

061fresh water to recycled at hope the construction crew hit a water line at hope elementary school on march 23rd if it was this date all current sixth graders prior hope fifth graders are also affected and parents have not been involved in the communication regarding this please can you advise when this occurred and also include the parents of hope prior fifth graders in all communication relating to this incident thank you all right this is new to me not usually much of a whistleblower but i feel like this entertains that my name is chris davidson i have two children in the schools here in carlsbad one at hope and one here at calavera middle i'm a landscape contractor i deal with reclaim water on a daily basis i've introduced reclaimed water to multiple facilities across the county

062del mar and oceanside and i'm very well versed in what needs to happen when reclaimed water is at a facility let alone a elementary school i've reached out to the department of environmental health and asked for all communications between the deh and carlsbad municipal water district district regarding hope elementary i have some emails that i want to read a few things on here this was monday june 22nd 2020 from jamel mccullough at the deh speaking with derek anderson at cusd just a little snippet out of the email jamel says again i cannot speak on behalf of the city of carlsbad however i did mention that you might ask whether any exemptions exist for your site since you expressed concern with recycled water being applied at your school the regulations in place for recycled water systems

063do minimize exposure to the public and of course the water is not intended for consumption design requirements include that recycled water never come into contact with seating areas handrails playground equipment and the hours of irrigation are limited to evening hours only there's a response here from mr anderson at cusd to demel you also mentioned that the city of carlsbad ordinance requires commercial customers to accept the reclaimed water and to pay for the capital cost of conversion ongoing increased operations and maintenance costs in addition to annual and i repeat annual cross-connection tests i have another email here from paul across to the deh hijamel just wanted to let you know that i forwarded tyler's email request they weren't plans yep yes your time is up thank you um did crystal jones already speak okay yes miss

064jones ms jones hi my name is christelle jones i live within the district i have two children one who's a second grader at hope elementary and i also have a sixth grader so a previous fifth grader at hope we want to know what other contaminants and the amounts that the students and staff at hope elementary have been exposed to and for how long via the contaminated water supply at the school this is my primary question and i think all the parents need to know this information as soon as possible in addition we are asking for answers to the following why wasn't the school shut down immediately on receipt of the water test results dated 11th of january 2022 according to that report the levels of copper in the water supply to my daughter's classroom which

065is room 10 and one of the school kitchen sinks exceeded the epa's national primary drinking water regulations the water is not fit for human consumption based upon the limited testing that was done at that time who was responsible for the interpretation of the 11th of january results a further six weeks had passed before his parents and staff were first notified of a problem and then subsequent closure of the school on 24th of february what is the explanation for that six week delay from receipt of the 11th of january results is it possible as sonja mentioned that the water was contaminated as far back as march 2021 when when the water line was severed during construction did the cross con the cross connection of supplies occur then who was responsible for signing off the plumbing work

066and the drinking water is safe for consumption during the entire period of construction works at hope element elementary how was this done what tests were performed why was the plumbing contract contractor in control of which water tests were conducted for safety during the period of complaints and up until the school closure on 24th of february this year thank you for listening thank you kim mcconnell good evening my name is kim mcconnell i'm a parent of two students at home elementary and we live within the district boundary i'm here tonight to express my concerns and hopefully optimism that we can find a way to do better it is difficult to find constructive words about the issues surrounding the water supply at hope elementary more importantly it is even more challenging and frustrating to determine the full

067scope of the issue including timing the root of the problem and how to address and present it prevent it where do we begin to approach and repair the fundamental issues of poor communication and safety risks that have been put upon our students and staff due to less than ideal decision making given the history duration and number of complaints what prompted the city to check on the reported suspicion of cross-contamination of water supply on february 24th what is the timeline of the events when did the contamination actually occur and if we do not know why not the information provided in the water updates is not clear information from the timeline of the events to the reason for testing and what was found in the water if the expectation is to provide multiple testing reports without clear

068explanation and incomplete testing it has been met but we need to do better than this we need to determine what went wrong and why it is such a hard lesson why do multiple complaints need to come through before considering the idea to listen rather than to just hear why was there inaction for so long why was the testing limited to e-coli contamination only why was the response from the contractor not questioned when it was stated that the murky and smelly water issues were only aesthetic nature what is the pathway back so that our students and teachers have confidence in the choices made i'm hopeful that we can have further discussion where there can be actual exchange of ideas and information to clear up the frustration bridge the information gap and to do better i come

069today to ask you to be completely transparent with the information that you have and to be truthful with what is not available and why it is not available please do not provide reports and requirements provide what occurred what has happened and what will be done to avoid this from happening again update the faqs to answer the questions if the faq asks what is found in the water provide a direct answer add the faq what will be done to correct this problem and to improve the system and actually answer the question we're not only looking at responsibility for what did happen but what did not happen and why our future literally depends on your action and in inaction please do better own the problem even if you think it is not yours casey gosalia good evening

070um my name is casey gosalia my third grader excuse me could you get closer to the microphone or lift up yeah okay my name is casey my third grader attends hope elementary um so all my fellow parents here you know and the callers have made some great remarks i don't have a prepared statement so i'm just going to make a few closing statement if you will this issue has been going on for what at least six months now the first time it happens you know and nothing gets caught or it doesn't get you know raised to the right level it's negligence second time gross negligence five times that's blatant incompetence and i i don't like saying that but that is what has happened blatant incompetence somewhere in the system somewhere along the ladder i don't

071want to play the blame game but multiple times the you know the teachers brought this up the principal brought this up even my son brought this up and when he said oh you know dad um i had colored water in school today and i thought oh yeah because he may have that he watched harry potter the other night so yes it is to some extent my fault it is to some extent our parents you know fall too to not trust our kids not give them enough credibility if you will um what i would like to say is you know carlsbad unified school district san diego county we are not some impoverished unfortunate county in the middle of nowhere in this nation we are one of the most expensive places to live in the nation this

072is not acceptable this is this should rankle and rankle for a long time i mean as as my fellow parents are already brought up all the issues all the points that we should go through the board should the trustee should go through what i would only say is you know involve the parents be more transparent the first time this issue was brought up by ms rossiter or whoever it was at the school um they could have used this parent square or social media to to reach out to the parents that parents this has happened and you know something fishy is going on and who knows either the parents may have some idea by either association by profession or we just learned or by experience that you know school please test for these other things besides

073just you know e coli or biological pathogens we should try to do that more often that's all thank you thank you we appreciate appreciate the hope community who came out tonight and we appreciate your comments so thank you for being here this is the time waitresses um williamson can i ask for that let's get closer oh sorry can i ask for the speaker um the blue shirt the the gentleman to pass on the information to the to superintendent so that the trustees can see that mr davis no could could i add that you copy the board of trustees as well um if it's possible could staff request that a copy be also sent to the board digitally please thank you uh trustees this is the time for discussion um i would like to to actually

074just start really quickly and typically we talk about amongst ourselves but i do have a a question for the superintendent and then to see if i can get support is there going to be a time scheduled where uh staff and perhaps the board could be meeting in a more town hall session with with the hope community so there can be interaction rather than at a at a board meeting yes ma'am we're working on scheduling that now thank you um trustees are uh is there any discussion this is not an action item is there any discussion ms rawlings and then okay i'm okay right okay thank you um uh i just wanted to say that i truly appreciate the hope community coming out and uh making sure that um that our board is aware and understands

075and hears from you and we do hear you i know i hear you and i am in full support of the board and um the staff coming out to hope and having a town hall as one of the speakers said we can't look in the past but we certainly can learn from the past and move forward and and do and do better and and that's my commitment to you that i will ensure that i am involved in this as much as possible and that i will do better thank you mr pearson glad that parents came out and expressed their not only their concerns but uh questions that haven't been answered yet um i'm confident that the investigation will take some time i don't know what the time is but we will get those answers i

076was glad to hear from dr churchill that we will be meeting with parents in the community to give them updates on where we're at in the investigation or at least the final investigation um it is uh disturbing i think my colleagues here know it's disturbing we share that and um you know i think the comments made on you know we're sorry apologize for this happening is there any further discussion ms williams i just want to make sure that uh we hear you and we want those answers what you the questions you you made we want those answers as well along with the other ques answers that we um posed that trustee williamson post um the statement that she made but we do want we're going to get those answers and um apologize truly and i

077will just echo those sentiments um and i apologize i'll look at you uh i i have a lot of questions as well and i encourage the hope community to forward those keep forwarding those questions so that staff can address those and that at the town hall meeting when it's scheduled we can be prepared with those uh answers for our community we want transparency and we want answers and so we're seeking those on behalf of our community as well thank you and thank you for being here tonight and sharing your thoughts thank you we now move to item 7.2 second interim budget report for the period ending january 31st 2022 trustees this is a discussion action item i turn it over to mr eric dill check check anything okay actually hey this one's working okay just

078give me a few moments here and looks like close to this one sorry just looking for the uh where to cast to no i'm not seeing the maker sorry i was able to find this tv earlier all the way at the bottom yeah i had it earlier all right let me send it to dr churchill the name of it again was maker and makers not on there actually no you got it as well right now okay i had it earlier it's not on here okay let me uh just share it with you really quickly or rob do you have it yeah hang on um oh okay no it's in my drops yeah i got it we will take a two minute break [Music] testing we are back in order we are back in session we

079are mr dill test test test all right thank you my apologies uh for the technical difficulties that we had i promise i ran this right before the meeting began the good news is that i was only going to present an abbreviated version of the presentation this evening on first interim uh the the dollars and cents when we really look at where we are from at second interim compared to first interim uh the bot to the bottom line is you know we're roughly in the same place and i'll show the uh the ending balance and while we did have some increase in revenue and some increase in expenditures the net effect of the bottom line was about the same and we did provide the full uh board report in the agenda item so i thought i

080would hit some highlights and since uh at a previous meeting when we did first interim there was a request to talk about our basic aid status i'll talk more about that than you know really giving the summary and recap again because the the attached report speaks for itself so themes really again talking about uh are teetering between lcff and community funded status in the future um as you can see just very quickly here as i just mentioned while we had increases in both revenue and expenditures the net change in the fund balance is you know roughly the same as what you saw at first in them just slightly slightly to the better on the revenue and expenditure history this graph that you're used to seeing the last two columns showing you where we were the

081last time we did the budget update in december and where we are now with with those slight increases and then of course maintaining stability across our ending balance with second interim revenue again uh you know a very uninteresting story the increases are typical in the local at this time of year as we receive dollars from donations the state dollars were special ed early intervention dollars that we were anticipating but we didn't have our grant letter so we didn't have it built in at first interim so talking about lcff versus community funding both our lcff and property tax will be going up next year but we we do have some opposing factors and with the local control funding formula the dollars per student will be increasing you know by a pretty significant cola however that increase

082on the dollars per student is going to be offset by a decrease in our average daily attendance for next year fortunately there is a proposal in sacramento the the governor and the legislature each have proposals to address what we're calling the ada cliff by providing a smoothing effect which i will show you in an upcoming slide that would insulate us from a just sudden and drastic drop when you compare our actual average daily attendance to that that we've been able to use for funding purposes for the last two years under the hold harmless property tax we have a very early estimate on our assessed value we don't get an update on property tax until the fall so we run with this assessed value increase we have not rebounded to where we were pre pre-pandemic in

083terms of year-over-year increase but the good news is the outlook looks better for next year than it did for this year when we were really capturing that 2020 year that did not have a lot of real estate activity the board has seen this slide before just uh the the blue being uh the changes in our year-over-year property tax growth and the orange being the uh the local control funding formula this is very typical and and actually when you're in basic aid you notice that your your property tax effect is always a lagging indicator on what's happening in the state because you're looking back at the prior calendar year for the next fiscal year when you're planning your property tax that always takes 12 to 18 months for the economic effects to catch up whereas lcff

084is a little more responsive to what's happening up in the state so this is exactly what we would expect to see this again was just a recap of our property tax history going back to 2015 to the present so you can see we're normally in the five to six percent range year over year this this current year when we were using 2020 numbers a very modest increase because of the effects of of the pandemic during that 2020 year with a projection on a rebound we may get an update on that which that orange line could go higher but right now this is the estimate we have from the assessor's office i already talked about the the enrollment and the average daily attendance and the proposal to uh to use a three-year rolling average on average

085daily attendance for funding purposes and this is exactly what that looks like with that top orange line being the the ada that we've been able to claim for funding purposes that dotted line being our actual average daily attendance so with using the governor's proposal which we think is the one that will will win out uh in the end and the ones in the legislature are very close so something very similar to the governor's proposal will make it its way through that orange line is the smoothing that we would have as the hold harmless years go away the good news also on that formula is if there is increased in increases in enrollment and average daily attendance and we go above that line we can claim that higher number so it's either your current year or

086that three year prior year average whichever one whichever one results in a higher level of funding so this does not let us i'm borrowing dr nye's laptop and this is actually a better looking slide on my laptop uh sorry the way the the mac to pc uh conversion it doesn't look as good here so let me explain what we have in in looking out uh you know the first three columns are uh are actual and so where we were the last two years and and where we are this year in terms of our our uh total lcff funding and the hold harmless that black line being our property tax line and when we put in our all of our assumptions which are all reviewed independently and you know we all we always use the most

087credible numbers that we have we ended up with a scenario where we are dead even between the governor's proposal on average daily attendance for the next two years and our projection on property tax those numbers will change we will probably have a different cola in may we may have a different attendance number the property tax number may change so all of these these factors do changes and we update them as we get better information but as it looks like right now coincident coincidentally we are neck and neck between basic aid and local control funding formula for the next two years and we'll continue to update you uh as we get better information as we work through the budget development process so the the question that was asked in december was what are the what are

088the pros and cons and what are the ramifications when you're when you're on the edge and you know the pro is that uh there's no benefit to being one one or the other the only benefit is that you always do get whichever calculates to the higher revenue number so that is the good news uh that you always get the higher of the two calculations also good news is when you have such a high level of property tax filling up that local control funding formula bucket it insulates us from state it cuts to state aid in bad years and so uh you know with if the state has nowhere else to go we fall back on our property tax line and we wouldn't go below that because we would able we would we would retain our

089property tax the cons uh it's just harder to predict and the between the two statuses local control funding formula you know your entitlement at the beginning of the year but with property tax you don't know what you actually collect until the end of the year so when we're in basic aid you know when we get there and we're deeper what you'll hear me say is i'll tell you next august how much we have to spend today because we the property tax estimate will be a budgetary estimate all through the current budget year until we close and then we know what we collected so it's a little bit more difficult uh you know to budget against that property tax number and you do have to be more cautious when you do that also there are some

090different revenue sources that come in and out of play when your basic aid versus local control funding formula one being supplemental property tax which is something that goes away and you just hope that your secured roll tax jumps up high enough to cover that loss of the supplemental tax and as i said any one of those factors when we're so close could cause a flip so living on the edge you know my recommendation would probably be the same as what we've been doing all along which was hold the line on our budgeting discipline because we are so close between the two you know we really can look at our local control funding level as a it would not go lower than that and so that would be a good target to budget against obviously we're

091going to to show all of the revenue that we anticipate but having a looking at the lower of the two for budgeting purposes would be prudent and again remember as i just mentioned property tax is always an estimate the board does have a stabilization commitment to to protect against those fluctuations and funding that happen when you're moving in and out it's there and as i said at first interim if we do have surpluses in the future we may want to consider augmenting that until we're all the way in or all the way out in one of those two funding scenarios not a recommendation today just a consideration for the future second so that was the quick update on the revenue piece of that on the expenditures um you know again a a pretty normal story

092here the certificated salaries that's really extra hours uh it's additional uh funding um for uh teachers who are overseeing the short-term independent study and then of course the increase to the substitute rate that we passed earlier this year we built that all in but again as i said when we when we add up all the additional revenue all the additional expenditures we end in roughly the same place as where we were at first interim this was just a quick update on the coveted relief funds in terms of how we plan on spending it no changes we should have a little bit extra to carry over into next year which we can use to sustain the existing services that we've used uh those dollars for i already spoke about all the multi-year uh projection factors in

093my my preamble on the on the revenue piece so when we update the multi-year projection and again this looks better on my laptop than when it looks on a map on a mac uh we'll certainly share the better looking version of this presentation but the dollars and cents are below if you just look across at the at the bars the blue is our unrestricted revenue and expenditures and then the small one is our is our unrestricted ending balance since this isn't labeled as well as it would have been if it was on my laptop let me just say when you look across things look pretty flat which to me i would have been saying this is stability is what you see over the current year and the next two years projected ending balance we're able

094to meet our our our required reserve requirements so we have a positive certification before you this evening uh and then finally uh is a new slide that i thought i would share with the board is just showing the unrestricted ending balance history and our reserves have been proportionally stable over the last six seven years while our expenditures have increased and our reserves have increased the percentage of the ending the unrestricted ending balance as compared to total revenue is roughly flat when you look across this any of these lines particularly the top line which is the total reserves you can see in 1617 we had a peak but then we came back down and we've been roughly in the same place for the last few years while it tips down just a little bit in this

095current year as the board knows we typically capture savings at the end of the year so that line should come right back up and flatten out when we close the books for this year and then this was just um looking back at the history of you know those years when the state funded the colon when they didn't and the orange line being that what was calculated as the cola and then those bars being what was actually funded and so you can see many years the state under funded the the lcf cola and growth to proposition 98 and so the reserves are there when the cola isn't and when i look back at you know this year of 2008 9 which was a 10 cut to public education funding that's where you were in may of

0962020 when you were looking at the budget that you were adopting because that was the proposal that the governor had on the table and it was going to be a sudden loss of funding that you we're not going to have time to respond to and that's where the reserves come in you know when you have that crisis fortunately there was a compromise that just said no cola that year and we didn't sustain the cut but had that continued forward you would have been happy that you had the reserves that you did and so with that we have the adoption of the second interim and positive certification tonight we'll continue to update you and then the next steps we would see the revisions to the governor's proposals in may and base that on the proposed and

097estimated i'm sorry adopted budget that we'll bring to you twice in june and then finally before i turn it over to the board for questions i want to thank ms araceli salazar who is sitting behind me um she is responsible for she might be behind the television you might not see her but she is here not only in person but here every day and the hard work really comes from her and her department and so thank her for all of the work that she does keeping on top of all of this very complex financial information and presenting to you a report this evening thank you very much mr dill before we have any questions i want to ask ms garcia to call for any comments from callers there's no colors on the line and we

098do not have any blue cards okay all right trustee are there any questions we'll start here and then move our walk our way down this from mr dill so you mentioned that uh in the new estimates uh the 80 is has been lowered do you have any idea what the percentage is at the lower can you give us an idea on the estimate as a percentage of lowering of the ada yes so um for this current year um we've seen a drop of even another two percent off of what's normal so if we were to uh calculate the number today we'd be at 93 percent uh of enrollment which we're usually at about 95 percent give or take a a fraction of a percent or so now we hope to garner some of that loss

099back as we complete the short-term independent study agreements um we can cap we can count that average daily attendance so we're hoping that it will be higher that's hundreds of kids it would be millions of dollars if we were to push that through the full lcff formula the good news is is that in the averaging proposal we would have about another 300 kids on top of our actual ada that we could claim for funding purposes next year [Music] thank you um can you hear me yes okay um so when we're talking about hundreds of kids on slide i think it's slide 11 that you show that we're comparing our ada 1920 to for this year correct yeah so yeah we're i'm showing a number of things and the the bars are enrollment the lines are

100average daily attendance and with the dotted line being actual average daily attendance and the the dark solid line being what we've been able to claim for funding purposes so for 2223 that or i'm sorry for we're still claiming here and then the drop occurs for 22-23 correct because this is the final year of the ada hold harmless and so when that expires it goes to either actual ada or in if in the state budget act they they pass a solution that would smooth the line then we would see the slope rather than the cliff what you see here is the slope since we have multiple proposals and we we really do believe that there will be a deal structured similar to this in the final budget act so we're showing what that would look like

101okay so then if that's the case then our expenses would also go down if we are short hundreds of students as well so when you talk about millions of dollars based on hundreds of kids the expenses go down as well correct well but we've been we have been adjusting our staffing to our our normal formulas so we have brought down uh you know staffing levels to to respond to uh the same drop in enrollment um but we've been able to capture that higher uh number uh for the last two years and so you know we wouldn't just automatically see that we would be reducing staff next year and you don't have a layoff notice a resolution in front of you tonight so it's not automatic that expenditures would just drop on the natural just because

102the funding is going away we would have to take some action to do that so our projections for enrollment or projections of ada are down but our expenditures are remaining the same in our projections is that correct would they would they would expenditures would remain the same but then rolling up every year for step and column and uh inflation and you know other other aspects we wouldn't make the adjustments until the following year correct got it thank you ms johnson you still have a follow-up to that question [Music] ms jones i'm sorry i'm having a really hard time hearing you maybe if you could and maybe it's just me but if you could slow down between each word that would help um issues so you're assuming it's a normal year where the state's not decreasing

103funding is what was happening in the years when when carlsbad was flipping and it was cut into basic aid assume just a normal year where you would see growth or flat funding you're always running that calculation of how many students do we have in each grade level times the local control funding formula adding up all of that entitlement adding up all of your property tax sources and which is higher and so if you start the year in basic aid status but by the time you reach p2 your enrollment has increased and that changes your your lcf calculation you would certify as lcff at the end of the year we would be owed state aid they would give it to us the following year we would be considered lcff the next year but we run the

104calculation runs every single year i did want to follow up on trustee rawlings set of questions okay so i think i heard you say mr dill that expenses would be stable could you clarify if we negotiate with our labor you labor groups when our expenses go up if we add increases in there yes that's correct and and we don't include those costs until we have certainty on what any uh proposed increase would be was it i can't where were we with miss jones or ms williams did you have did you ask your question yet you're good okay miss jones do you have any other questions or were you are you covered um [Music] yes and we have the ability through attrition to adjust on the fly um as as mr deal indicated there there's not

105a riff resolution before you this evening today tonight would have been the statutory res statutory deadline for such a resolution based on your board schedule but we still have the ability to adjust we think pretty nimbly as the year progresses [Music] yes we're doing that right now in fact we're developing campus monitor formulas we are we just pushed out our base allocation staffing for certificated staff which reflect our enrollment projections for next year and show some adjustments based on those numbers and i and i would follow up and say that every vacancy is an opportunity to save and so anytime that we do have a vacancy we would evaluate is this a position that we would need to refill and that's in good years and bad years um ms rawlings and then mr pearson and

106just as a follow-up we have if i recall 50 or 60 temporary teachers this year in order to address some of the coveted aspects is that correct yeah in that ballpark now some of those are you know obviously covering for teachers on leave job shares for example this evening on your agenda you've already approved in the class in the certificated personnel report i believe 11 job shares so that would create a need for 11 temporary employees next year as an example so those things as teachers apply for leaves for next year you know we adjust those as we go but many of those temporary positions don't require rifts is that correct that's correct thank you mr dill when would we hear about years three and four in these in this scenarios and i know there's

107a lot of what-ifs that go into that when do we hear that i'm sorry i missed the first part of your question when would we hear years three and four our outer years regarding the budget yeah so so years three and four are always just projections of known factors so you know we we will not have a certainty on the cola until we actually get to that that fiscal year but we look at the school services of california dartboard which has an economic outlook which predicts the cola you know we will you know look at our property tax number and if we start to rebound to something normal maybe we will build in a more normal growth pattern on property tax but until we get to that point where we see it i probably won't

108and so again it's every multi-year projection we look at all of the factors project them forward but it's it is not a predictant prediction just a projection which always gets more certain as we get closer see no further questions ms garcia there was no public comment correct there were no public callers now okay all right then we will move to me i have a motion to approve the second interim budget report for period ending january 31st 2022 so move pearson trustee pearson made the motion trustee jones seconded the motion is there any discussion ms jones and then ms rawlings foreign so assistant is a great sort of attractive activity that also be proactive and advise the board if there will be difficulty of spending those times on you know as well as activities [Music] so

109are you asking for a request and getting board support or you just want to make us be mindful okay thank you dr churchill says he has it totally under control so we're good okay ms rawlings thank you and mr dill thank you for answering all my questions ahead of time of this meeting so um but i did want to state that i would not be in favor of um of adding budget surpluses to the lcff stabilization fund i've expressed disagreement with that fund for many years now i truly believe those funds need to be in the classroom and into programs and not sitting in a bank account from my perspective when you talk about on slide 13 when you talk about that we're always going to get the higher amount of the calculation then in

110my mind there's no need for that specific fund especially when we're carrying an additional two percent than what is required from the from the state and we're looking at almost a um our funding and balance continues to grow over time so i would not be in favor of that and i just wanted to make that statement thank you mr pearson i'd like to just give a second to trustee jones comments as we go pursue this particularly if in fact we start realizing a lower attendance in particular and some of our negotiations are increasing so i'd like to just add to that perspective thank you me i have we've already had a motion miss garcia would you call for the vote trustee jones trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes motion

111passes unanimously thank you we now move to item 7.3 election of 2022 csba region 7 delegate assembly candidates trustees this is a discussion action item i'll turn it over to dr churchill thank you each year the california school boards association cspa holds elections for representatives to csba's delegate assembly the policy making body of the california school boards association each school board may submit a single ballot to csba attached as exhibit a to this item on your agenda two years ago our board voted for only one candidate claudine jones you have the option to do so again this year or to vote for as many as nine candidates [Music] ms garcia would you before we have any questions ms garcia would you see if there are any callers who wish to speak to this matter we

112do not have any callers on the line and there are no blue cards submitted for this item thank you then are there any trusty questions no trusty questions yes um my understanding is we do board questions first then check for a public comment the reason we're i had now announced at the beginning of this meeting that we're doing it this way is because if there are going to be if the time is going to be cut i would like the people who are going to be speaking to us to know that their time is going to be cut so they were not going to be speaking then but we were going to see if how many there were so i could tell them okay items say that again that was for all agenda items for

113this meeting only as long as we're going to be cutting possibly cutting cutting their time i thought that it would be fair to let them know about how much time they would have so in other words rather than having the full three minutes if we know how many callers or how many speakers they're going to be we can say okay you will each get about a minute and then they'd be able to have time as we're having our questions to have it to cut their comments but that's just for this meeting or that's from now on from now on so if there's a concern about that we can have that discussion yeah again i was just checking thank you yes that was yes that was just that was that i had read at the beginning

114a new policy that i had a new practice that i was was thinking i wasn't clear if that was just for certain uh agenda items or if it was for all agenda items from this point forward i was trying to have it be for all agenda items so that would be consistent thank you yeah yes were there any questions ms jones a question thank you very much for that i move that we approve claudine jones as a candidate for the 2022 california school boards association region 7 delegate assembly as presented in exhibit a is there a second second is there any discussion and miss jones if you want to try to convince us okay right mr pearson it's good i can see trustee jones direct now he sees who i'm speaking to this mic what

115i've really appreciated in your representation of this board on that board or delegate assembly is that you come back with very complete information that helps me understand what is happening at the csva level and that is very much appreciated because you take a lot of time away from me for researching things so i very much appreciate it and you know i'm looking forward to you continuing to do that ms rawlings and i just want to acknowledge the additional time and effort that it takes out of your home life and your it's not this is not a paid position for you or there's no additional things that you get out of it and representing us um in this level and at the executive level and so truly appreciate the time and energy you've been willing to

116give for um to provide us with the information from csba so thank you for your efforts and um i wholeheartedly will be voting in favor of you continuing that thank you miss miss williams just to be brief i just want to echo the same sentiment so i appreciate it speaking to the microphone i'm sorry i just echoed the same sentiment so i wanted we appreciate you a great collaboration uh [Music] with a variety of issues so i appreciate the support and i look forward to another year or two in delegate assembly ms garcia would you please call for a vote trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes motion passes unanimously thank you we now move to item 7.4 revision of board policies second reading trustees this is

117a discussion action item i'll turn it over to dr knight thank you president williamson trustees dr churchill this is the second reading for these two board policies and staff's happy to answer any questions that you have at this time ms garcia have any would you check to see if any callers wish to respond to this item if any caller wishes to provide public comment on this item press star 9 to indicate you wish to speak we do not have any callers that have indicated that like to speak and we do not have any blue cards thank you trustees do you have any oh pardon someone just raised their hand up and went down okay okay then there will be one speaker after we have um our questions trustees do you have any questions then all

118right now is the time for public comment speakers are asked to state their name and indicate whether or not they live within the boundaries of the school district when we call the last four digits of your phone number press star six to unmute you will have three minutes we will have the timer on the screen and we'll mute your mic when your time is expired the first caller is 0219 please press star 6 to unmute yes we we hear you go ahead okay um i'm just calling because i'm i am i'm a mother of um my daughter went to aviera oaks elementary school and um she well we moved only a couple blocks and we're still that's still our close to school but we moved a couple blocks away and now we live in the

119uh off of alga and like altisma way and so we were told the day before she started aviar oaks middle um and she had already picked all her classes and she had friends there but that she had to be transferred to the san marco school district to san elejo middle school which is already started two weeks earlier and since she's and so we were told to do an interdisciplinary district transfer because we only we're only a mile away from this school and the school that she currently has to attend is 14 miles in the morning each you know 14 miles in the morning 14 miles in the just just driving i mean just even from the perspective of the environment like there's this my car doesn't need to be on the road for that much

120in traffic when the salvia oaks middle is so close and i'm just wondering um my inner district transfer request was denied and since since it was there's um there's a lot of different issues like the that school district like she's she's been made to read the same book same required reading now two years in a row um she's when she was at in your district when she was in our district she uh she was 97 percentile in the fifth grade for the united states and now her math now she's they almost want to put her like in special ed because she's um she does not like the curriculum the curriculum is so dumbed down it's the math she was doing in third grade um it's all very sad to see a kid just lose their

121passion for school and lose their losing she's always been above grade level in all of our classes and now it's just i i don't know why i guess i'm just trying to get advice and maybe some answers because the speaker would not have been able to hear me um i was not able to redirect her to have her speak to us at a different time so i'm hoping in the future we can fix this situation that if there's if there's a way so are there trustees do you have any questions okay um discussion or question question question yes so once i know this is during this is this we're making these modifications because of covid um the situations so once it's done is it going to be do we have to come back to revise

122these policies or is it yeah the thought is that the two-year exemption when students turn 16 for the physical education we vetted that through both department chairs at both of the high schools and at this point in time i i don't think that it would come back for any reason other than a new board policy revision we we can certainly bring it back we we have a number of students right now that we're not able to participate in a physical fitness test and that's the reason why we're pushing this board policy forward is you know they're in other classes academic courses in need for graduation so um to answer your question i don't know if it would come back but as as at this point in time we don't plan on bringing it back other

123than regular revisions okay and so it's going to expire then though that just is for the two years right i'm sorry repeat it's just for two years or is it what the what the egg code says is that students that are 16 years or older can apply for an exemption from the physical fitness test and not have to be enrolled in four years of pe and so we're just adhering and updating our board policy to allow for that exemption so and then the other thing the other provision that we added in there is we've never we've memorialized it but we've never instituted on our board policy about the community service hours and that's also the other revision that we've done here is put that into this board policy i guess what i'm saying is once

124we've resolved all the covid issues these requirements will be modified back to the original no the exemption's part of egg code and so okay i got you we we don't think that we'd be bringing it back other than for regular other revisions thank you did that answer your question all right me i have a motion to approve board policies 61 42.7 and 6146.1 as presented so move jones second pearson trustee jones made the motion trustee pearson seconded the motion is there any discussion ms rawlings i was able to clarify with dr nye that in the future as we've requested as a board that changes to board policy would be presented with highlights and um and underlines and strikeouts so we can see what the changes are and that was my question and so i was

125just want to make sure that we were able to clarify that in the future they will be presented in that way thank you dr knight i believe we're going through a process uh to you know do large batches of our board policy revisions so that's what i was referring to so whatever that process is and the outcome of that will adhere to that absolutely so would that require consensus from the board as that's a direction to staff we've already made that direction to staff when we adopted the policy piece and my question was why wasn't this policy presented in that way and so i just wanted to clarify for the rest of the board that that it was asked and answered but i want to make sure all of you knew about it yes with

126no further discussion ms garcia please call for a vote trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes motion passes unanimously we now move to item 7.5 cdph modification of universal indoor mask mandate trustees this is an information discussion item i'll turn it over to dr churchill thank you [Music] too many screens here there we go almost one more second sorry there we go thank you so this first slide is from california department of public health as you can see beginning next week cdph will move schools and child care centers from a requirement of masks to a recommendation of masks and indoor settings while the mask requirement has changed a number of other things have not including the current decision tree the flexibility is allowed in the group tracing

127approach and the requirements that school workers which includes volunteers be vaccinated or subject to weekly testing we're told the vaccine or test requirement will be in place for at least several more months if not for the rest of the school year to be clear there's also no change to our commitment to provide a safe and respectful learning environment for all students students who choose to not wear a mask can expect to be treated with respect students who choose to continue to wear a mask can also expect to be treated with respect teachers counselors principals and staff will continue to support students academic and emotional development and will ensure a safe space for all as this slide from the state shows we've got multiple layers of protection in place and that's contributed to our schools in

128carlsbad unified remaining open and safe the board report in board docs indicates a variety of additional virus transmission mitigation strategies and we will reiterate those in a district-wide message tomorrow it's staff's intention that our district not be more restrictive than the county of san diego and the state of california we will implement the flexibilities allowed by cdph and the county of san diego health and human services agency as soon as they relax the indoor mandate which would be at 1201 am on march 12 2022. thank you ms garcia would you see if there are any callers who are going to wish to speak on this matter if any caller wishes to provide public comment on this item press star 9 to indicate you wish to speak we have one caller who has indicated that they'd

129like to speak and one blue card has been received for a total of two comments so they will both receive three minutes trustees do you have any questions mr dr churchill very much like the comment about respect between masked and unmasked students um is there some plan for the students in terms of the transition excuse me is there a plan for the transition in terms of facilitating conversations between the students as it relates to respect i'll ask dr nye in a moment if he has anything to add but as i noted we will send out a district-wide communication tomorrow principals are then prepared to send follow-up communications to their school communities on friday uh and and we will as we've done consistently we'll continue to focus on uh healthy relationships and positive interactions on campus

130and have high expectation for student behavior dr and i don't know nothing else as reference there seems to be some disconnect between students and employees do we anticipate that disconnect will be patched up through cal osha yeah we've been told that um the the requirements for staff will mirror that of students starting uh on march 12th so we're not terribly concerned i don't know rick is shaking mr grove is shaking his head i don't know that we've seen anything specific from cal osha i do know they're not scheduled to meet until april so we we can't expect an update in advance of that but um we're we're told to anticipate treating staff the same in terms of the flexibilities that's right what we've learned is that the ets the emergency temporary standards where they will

131continue to diverge is on the area of testing availability for staff who are exposed at work that's the piece of the ets that will continue unchanged but the masking requirement will mirror the students we will now move to public comment ms garcia speakers are asked to state their name and indicate whether or not they live within the boundaries of the school district when we call the last four digits of your phone number press star six to unmute you will have three minutes we will have the timer on the screen and will mute your mic when your time is expired the first caller is zero three six two please press star six to unmute good evening this is erie spangler i am a parent in the district i live within the district and i'm also an

132attorney i'd like to thank all of the students who decided to protest against the statewide school mass mandate by peacefully unmasking in the recent weeks as well as all of the families who supported them and advocated for them and the teachers and staff who also supported these students and treated them with dignity and respect after advocating for math choice for students since the middle of last year i can say with confidence that the state would not have ended this mandate without student protests throughout the district state and county i would like to draw attention to the board to the conditions that these students endured and the backlash that they are still experiencing in the district the majority of students who participated in the mass protest often sitting outside in the cold weather sometimes even in

133rain and hail were denied an opportunity to complete their assignment and were marked with unexcused absences even though they were in school a few were actually threatened with calls to the police i understand that the district has taken the position that students who chose not to attend class are truly but the students who participated in these protests did not choose not to attend class these students all wanted to attend class they simply chose not to wear a mask the students were excluded from class based on the district's decision that their unmasked spaces posed a clear and present danger to others under section 48213 of the ed code even ignoring the absurdity of that decision that an unmasked child without any symptoms of any virus poses a clear and present danger to the life safety or

134health of others under the ed code the absolute student's teacher is required to provide a student who is absent because they purportedly constitute a clear and present danger to make up assignments and tests and receive full credit for the same within a reasonable amount of time moreover the school is also required to require to record the student's absence as excused this did not and has not occurred in our district the majority of unmath students who protested or marked with unexcused absences even though they were at school ready to attend class i've attempted to address this issue with the district directly and with its attorneys but i have not received a satisfactory response on behalf of all of the students who peacefully protested mass mandate i'm respectfully requesting that the board direct the district to re-evaluate

135these attendance issues and also ensure that students have an opportunity to complete assignments and tests that they missed thank you we have one uh speaker in person mr scott davidson and i believe that you know to state your name and whether you live in the district and you have three minutes [Music] uh good evening again my name is scott davidson could you speak a little bit closer to the microphones of the people thank you good evening trustees and superintendent churchill my name is scott davis and i'm the parent of a child in cusd as we finally allow our children to remove masks in school it is concerning to see that carlsbad unified continues to state in this agenda item that it will be implementing countless ineffective costly and in some cases counterproductive covert restrictions now

136that all of the cdph requirements have been removed all covered mitigation measures become simply recommendations that that can can and likely must be removed by the board without explicit requirements from the san diego county health department as many of us have been emphasizing since the beginning of the pandemic the use of cloth and surgical masks provides mere minutes of protection making them entirely ineffective in a classroom setting n95 respirators are not approved for and are actually dangerous to children any effort to continue to provide or suggest that masks or respirators are effective creates enormous liability for any remaining students who may have a valid health issue and need to avoid infection within months of the start of the pandemic it became clear that surface and air disinfection measures were unnecessary to combat an aerosolized respiratory

137virus which does not survive on surfaces yet this is still listed as a mitigation strategy likely costing thousands of dollars and potentially creating a toxic environment with the harsh chemicals being used in our classrooms the use of plexiglas barriers is still listed as being used in certain areas despite admissions from cdph that not only are these ineffective they likely increase the risk of infection by blocking natural and needed air flow in indoor spaces these should be immediately removed anywhere they are still used on campus finally the continued push by our school district to recommend a vaccine still under emergency use authorization for the vast majority of students is dangerous and disconcerting as was reported last week in the new york times vaccine effectiveness for children aged 5 to 11 dropped to only 12 percent after

138four weeks and the pfizer data showed it dropped to negative efficacy after five weeks what does this mean for schools in berkeley unified 79 percent of the students who tested positive in january were vaccinated another study released just a few days ago on the risk of myocarditis in children particularly in teenage boys significantly called into question whether the risk of myocarditis from full vaccination outweighs the risks from coveted and healthy teenage boys these are not decisions that our school district should be making at this point as there is little to no benefit to the school community from vaccination due to limited efficacy against infection it is far past time for cusd to get out of the business of coveted restrictions for a virus less deadly to kids than the flu let's focus on what we're

139supposed to be doing educating our kids and let the parents and their own doctors make decisions on what's best for their health thank you [Music] thank you board uh we will now move to the discussion ms rawlings i had an additional question actually that was raised by one of the callers um any student that wasn't wearing a mask that was asked to leave the classroom was their parent contacted and asked to pick them up yes thank you i have a statement to make the mask mandate has been instrumental in allowing many students and teachers to be comfortable attending class this year due to their own or their extended family's health concerns for others the mask mandate has been the source of increasing frustration particularly when there was no clear path towards ending the mandate to

140me personally the benefit of the student mask mandate did not justify the potential mental social and emotional outcomes however i did not advocate following the example of some other school boards who voted to stop enforcing this mask mandate because i knew it would place our staff in the position of having to choose between violating the state mandate or violating the board's decision also i knew it could expose the district to huge financial liability neither of those outcomes would be good for students now or in the future i acknowledge that other members of the family of the community felt that if we truly cared about our students we should have taken that risk i can see why they feel that way even though i came to a different conclusion in recent weeks some students chose to

141boycott class which in turn placed an increased burden on site leaders office staff and teachers at times tempers grew short inappropriate words were said relationships became strained we can continue to dwell on those slights and focus on our differences we can choose to be divisive or dis dismissive of those whose opinions we don't share or in the immortal words of queen elsa we can let it go not only that we can reach out and apologize to those who may have been hurt by our actions i believe we have an opportunity next week to start repairing relationships in our community i invite parents to talk to their children about being kind to other students whatever their mask status i invite a parents to model all adults to model respectful behavior towards those with differing opinions and

142i invite my husband to stop making belittling remarks about drivers who choose to wear a mask while alone in their cars however i don't think that will ever happen are there any other is there any other discussion all right we now move to item 7.6 resolution 31 21 22 continuing board of trustee authority to hold virtual meetings pursuant to ab361 trustees this is a discussion action item i'll turn it over to dr churchill thank you just a couple of quick slides here we've shown you these in the past this is from the county of san diego published a week ago showing a steep decline in the number of positive cases over the last couple of weeks there's still a differentiation between not fully vaccinated and fully vaccinated individuals this is the chart from the city

143of carlsbad also showing the sharp decrease in the number of cases over recent weeks staff recommends continuing in-person board meetings we also recommend approving this resolution every 30 days in the case that a trustee is required to quarantine or isolate due to covet 19 exposure or infection approval of the av 361 resolution would allow a trustee in this case to participate remotely the brown act does allow for remote participation but it puts in a few additional hurdles in place approval of this makes it easier for a trustee who's required to quarantine or isolate to participate remotely thank you dr churchill before we have any questions ms garcia would you check to see if there are any callers who wish to speak to this item if any caller wishes to provide public comment on this item

144press star 9 to indicate you wish to speak and we do not have any colors and we do not have any blue cards for this item thank you any questions ms rollins i just wanted to clarify that by passing this resolution a board member would not necessarily have to have coveted or be quarantined there could be other reasons that would necessitate virtual participation correct the the the intent here is to respond to the cove at 19 situations so the intent of passing this resolution is to to give individual trustees flexibility in the case that they're required to stay at home because of exposure or a positive case that didn't quite answer my question though um could a board member utilize this provision in other cases besides that it would not be my recommendation to do

145so to do so um as i said within the brown act there there's a provision for remote participation for trustees i don't know that we've we've exercised that in my tenure here but but it does exist um we have exercised that and what is necessary under the brown act is wherever that trustee is it needs to be posted so that address is posted in the agenda according to my recollection and then wherever that person resides or wherever they will be a note would be posted saying this is a board meeting and you are welcome to come and participate so so that and with under the the emergency that that is does not happen there is no address posted there is no note need to be posted so i i believe that's the main difference ms

146rawlings so just to clarify the only reason a board member would utilize this provision would be for quarantine or covet any other reason would need to follow the brown act provision correct yes any other questions may i have a motion so move jones second rawlings any discussion ms garcia please call for a vote trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes motion passes unanimously thank you we now move to governance team reports and requests are there any reports of ms williams and then ms rawlings so i attended two elac meetings the past couple weeks one for high school and one for elementary director abset went over the lpac testing reviewed the lcap goals and informed parents about taking the lcap survey principles went over the resources available for

147the english language learners students at their schools then at the end of the meeting a question was posed if there was anything they would like to add or change in the lcat the complete feedback will be coming back at a future board meeting with the results from the lcap survey but i just wanted to highlight a few items that were expressed at both meetings there was feedback feedback expressed that additional funds resources and resource teachers are needed at the english language for english language learners but there was also positive feedback about the new community liaison positions at all levels and thankful at and the elementary level we're thankful about having the counselors because they've never had counselors before and along with um ecstatic about the parent square as a communication tool thank you ms rollins
