002staff thank you for attending we'll begin tonight's meeting by my leading us in the pledge of allegiance that will be followed by trustee pearson leading us in a moment of meditation and trustee jones reading from the district vision ready begin i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice for all i'd like to read a few quotes of unity during this time of adversity we're only as strong as we are united as weak as we are divided and that comes from jk rowling from harry potter and the goblet of fire unity to be real must stand the severest strain without breaking and that's from gandhi unity is strength division is weakness and that's a swahili
003proverb unity is vision it must have been part of the process of learning to see and that's from henry adams and the last is from henry ford coming together as a beginning keeping together is progress working together is success thank you thank you trustee pearson our students are engaged self-directed learners they are exposed to different learning environments and pathways students aspire to expand their talents and achieve excellence they are good thinkers communicators and problem solvers thank you ms garcia would you please take the role uh student representative mina is not here this evening so i'll move on to trustee jones here trustee williams here trustee rawlings here trustee pearson here trustee williamson here thank you uh we need an approve a motion to approve the february 16 2022 meeting agenda samuel pearson ii jones trustee
004pearson made the motion trustee jones seconded the motion ms garcia please call for a vote trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes uh we now typically removed from uh moved to the report by the student representative but as we were just told that mina posakovic was unable to join us this evening she has shared her report with ms garcia who will send it to us via email meena is sorry for her absence and noted that she will do her best to log in to join us sometime during the meeting tonight we now go to the superintendent's report dr churchill thank you trustee williamson tonight i'd like to provide an update on the indoor masking requirement for students in california our position is clear we've asked state public
005health officials for a road map to relaxing the indoor mass mandate for schools based on public health data we are disappointed that they have not yet shared a clear detailed and actionable plan as soon as flexibility is allowed it is our intention to provide that additional flexibility to students and staff we do not plan to be more restrictive than the state and we want to make sure that our families and staff know this in advance of an upcoming announcement from the california department of public health there is an assumption that our district has the local authority to ignore or defy california department of public health orders we simply do not as a public agency public schools are legally required to enforce state and county mandates or risk closure and institutional and personal legal liability this
006week we've seen a number of students exercise their constitutionally protected first amendment right of expression in cases where a student decides to not comply with the state's indoor mass requirement school staff will provide a safe outdoor location for those students while we contact their parents and ask them to pick them up in the case that a parent is unable or unwilling to pick them up we'll maintain supervision of the students in a safe outdoor location until the end of the school day and will do so with compassion and understanding we view this expression of free speech through the same lens we've looked at other expressions of free speech via walkouts or protests over the years while it's important to know that you have the right of that you have the right of expression it's also
007important to know the school's obligations and the district's policies teachers are to follow the same procedures for marking attendance as on any other day as the student's absence will be considered unexcused the usual consequences for unexcused absence will apply we recommend that teachers follow their usual practices for accepting work missed due to unexcused absences in alignment with our board policy 6154 which indicates that students may be given the opportunity to make up missed work quizzes or tests but that there is no obligation to do so please understand teachers and staff are in a very difficult position in august state public health officer dr tomas aragon sent a memo to all school district officials outlining the quote substantial legal financial and other risks if they do not follow a mandatory universal masking directive he included detail
008about the responsibility of governing boards and he also specifically cited that certificated staff such as teachers counselors and principals may be subject to referral to the to the commission on teacher credentialing for disciplinary action for violating a mandatory legal duty to implement the masking requirement our teachers principals and staff are between a rock and a hard place they just want to teach they want to take care of kids they don't want to fight battles about statewide mandates but they're on the front lines they're the ones asked to enforce the rules and they're far more accessible than any of the statewide decision makers please i'd ask everyone to be reasonable and respectful as you engage with our school employees with students on and around our campuses and with other parents who are doing what they think
009is best for their kids we are disappointed that the state has not provided more clarity on next steps for moving from a pandemic to an endemic response we'll continue to advocate for a clear detailed and actionable plan that can be implemented without any further delay i'll share more information just as soon as it's available thank you very much dr churchill we now move to oral communications for education code 35145.5 and government code 549 54.3 members of the public have the opportunity to address the board on any item of of interest to the public that is within the subject matter jurisdiction of the board ms garcia please call for public comment on non-agenda items at this time if any member of the public wishes to provide public comment on non-agenda items now is the time to
010do so if you are on the line press star 9 to indicate you wish to speak on this item and it appears that we have nine callers for this item as noted in our agenda no individual presentation shall be for more than three minutes and the total time for this purpose shall not exceed 20 minutes ordinarily board members will not respond to presentations and no action may be taken however the board may be given direction to staff following a presentation trustee williamson the number of speakers will exceed the time allowed it for this item per board bylaw 9323 how would you like to handle the number of callers i'm doing some quick math i wish i could do it in my head trust you williamson that the number actually increased to two yeah 11 to
01111. okay so if everyone how about if we keep it uh dr churchill uh or actually board members um as you know tonight we have a very heavy agenda so my inclination is to stick to our schedule 20 minutes for all oral communication comments and limit each individual to about two and a half minutes and i believe that with two and a half minutes we can hear all of the those who are wish uh wish to speak with us uh board members could you show me by thumbs if if you are okay with that okay great all right that's what we will do thank you we appreciate i appreciate your support on that so we can go ahead and proceed with two and a half minutes per speaker ms garcia okay so speakers are asked
012to state their name and indicate whether or not they live within the boundaries of the district when we call the last four digits of your phone number press star six to unmute you will have two and a half minutes we will have the timer on the screen and we'll mute your mic when your time is expired the first caller is caller 2966 please press star six to unmute can you hear me yes we can excellent good evening trustees this is laura pitts the ceo of carlsbad educational foundation i appreciate the opportunity to connect with you this evening charles educational foundation's events were put on hold for nearly two years because of copit19 that said it has given us ample time to shift our efforts from the multiple events we used to run to one signature

015the impact of courtesy and promoting the need for respect of our peers and neighbors at kelly elementary every student decorated a t-shirt with a kindness message and they have a new spirit wear day to wear their t-shirts every thursday magnolia pta hosted a very successful block party while hope elementary pta had a winter wonderland carnival several elementary p school ptsa ptas are now busy planning jog-a-thon sciences and parent nights out che pta just had a record-breaking jog-a-thon last week poinsettia pta is getting ready for its upcoming father-daughter dance our middle school ptfas are supporting students with honor roll recognitions 650 students made the honor roll at aomf this year dine out nights teacher mini grants valley has awarded an unprecedented number of mini grants this year and they are now busy coordinating eighth grade trips
016to knox berry farms high school ptsas have been equally busy with student and grade level grants hosting appreciation luncheons for counselors holding resume writing workshops career chats and more thank you for your continued support of the carlsbad ptas as you can tell we are busier than ever just the way we like it thank you for your time thank you and our next caller is eight eight six six please press star six to unmute hello can you hear me hello my name is sharon okay great my name is sharon mckeeman i do live within carlsbad i have four kids in the carlsbad schools and i am the founder of let them breathe and we are here now in the same situation almost two years later uh where the unions are dictating state policies that are not
017in the best interest of our children we understand that you are between a rock and a hard place and that's why let them breathe sued the state to try to get rid of that mandate so that you could do the right thing for students and have local control back unfortunately they've been hiding behind the emergency order even though the super bowl proved there is no state of emergency so we do appreciate that you are at least of course our kids have a right to be in the classroom but that you are at least expressing that they have a right to be on campus and that you will accommodate and supervise them in a safe manner this of course means they cannot be harassed they cannot be left out in the rain like they were this
018week our legal council has reached out to you and we're expecting for those accommodations to be made in a safer more reasonable manner however the mistake you're making is if you're telling students they have to leave class because not wearing a mask is a health concern which we disagree with but if that's what you're alleging then you cannot also count them absent because you're alleging that they're leaving before a health concern if which it sounds like what you're doing is actually saying that you are dictating the time manner in place that they can exercise their free speech again you are the ones making them leave class a student is allowed to come into class with a t-shirt that says something that expresses their free speech it's the same as what they're doing so by you
019telling them they have to be outdoors you are dictating the time man or place that they can exercise their constitutionally protected right to free speech on campus which means you cannot count them as absent it cannot lead to truancy and teachers have to accept work from them you said that you want teachers just want to educate they we just want to be able to you know give these kids an education but focus on teaching then of course they should be doing that we've seen kids at carlsbad high school sitting outside studiously doing their work even without instruction that work absolutely must be counted um and and you know included in their grade these are kids that care about their grades they care about their future and there's no reason they should be punished for their
020free speech so that's something that our legal counsel has already reached out they'll be pursuing having a thank you and our next caller is 7181 please press star 6 to unmute good evening dear trustees and superintendent churchill my name is scott davidson and i'm the parent of a child in tusd tonight i expect we're experiencing a bit of deja vu last year around this time many had come to realize that school closures were a mistake and that they were harming our kids and that our school should be open but we are prevented from acting in the best interests of our students due to the politics of this state which allowed the powerful teachers unions to essentially hold our children hostage from their education well here we are again evidence continues to come out almost daily
021that masks and mass mandates were ineffective at stopping cover 19. states like texas which never mandated masks had fewer cases over the winter than states like california which did on sunday we hosted a super bowl in los angeles during a state of emergency where none of these 70 000 fans who were required to wear masks were wearing masks and now we have randy weingarten the president's largest teachers union in the country admitting that masks are harmful to learning and socialization and that kids need to see each other's smiles but once again california is allowing everyone else in the state to choose whether to wear a mask except for students in schools and fittingly prisoners when governor newsom was asked about this last week he said that a few stakeholders needed a little more time and
022then last weekend it was revealed that once again the teachers unions were the reason there is no road map or metric for cases or vaccinations that is preventing our students from not wearing masks it is simply a political decision because the teachers union has once again decided to hold our children hostage from a normal education what we're asking cusd to do is have some courage and creativity other districts have decided to enforce the mass mandate through other means that do not require exclusion of students from class some have analyzed their legal rights and responsibilities and realize that there is no legal basis for cdph to force schools to strictly enforce a mandate that is unscientific and arbitrary we need to see that creativity from this board and this district thank you thank you and our
023next caller is one seven three two please press star six to unmute hello this is kellie laberthon carlsbad resident parents are rightfully concerned about their children's mental and physical health given the mandatory masking of children who are the least likely to suffer any adverse effects from covid and yet have suffered more than any other group from masks and lockdown policies which are entirely political the fact is that the cloth and paper masks we've worn the last two years did nothing to stop the spread of kovid seventy percent of americans oppose mask and vax mandates and science and data support this where is the leadership in carlsbad in fact you don't even have to lead just join us over here in the mandate free zone conversely you all have no problem leading our teachers and children
024down the nefarious path of indoctrination in marxist ideology through your equity and cultural planning programs the power privilege wheel which segregates individuals based on a variety of identities including race and gender was just this week recalled by the poway school district because their parents pushed back when they discovered this graphic was being used this power privilege wheel is the same racist and divisive graphic used by dr dorsey in his trainings the wheel targets private property as a form of power and oppression when in reality this is the cornerstone of liberal democracy you trustees and staff have the opportunity to change course before you go further down the path of contracting with board of education the san diego board of education and dr dorsey in the three-year cultural plant it's worth noting that just yesterday in
025san francisco probably america's most progressive city the voters recalled from office three school board members who refused to open the school it wasn't even a close vote between 79 and 72 percent of san francisco's voted them out the time is now unmask our children and walk away from the woke crt agenda get back to reading math science and civics thank you very much thank you and our next caller is two three five five please press star six to unmute madam chair jd scranton here your number one sub and i do not reside in the district before i begin my substance remarks i see that you've taken ben churchill's finger off the public comment button i will take this as an admission from you that i was right about the ethical dilemma i warned you about
026now in our last hour together you were preparing another regular performance review of ben churchill's work i notice your draft minutes for your february 9 meeting on this matter are missing so i must ask again what are your intentions with respect to public accountability for one of carlsbad's highest paid government employees next i could not help but notice last hour when our hr guy rick grove made his proposal for an increase in substitute pay that not one of you hit the pause button when he openly admitted that he's leaving 20 empty spots unfilled in our classrooms due to the substitute shortage you think to ask the management how they handled those vacancies was there no licensed teacher in those classrooms if any teacher failed so bad in the basic performance of their jobs you would
027write them up and discipline them why are you giving preferential treatment to management you can question rick here tonight just pull the certificated report off the consent calendar and question him directly here tonight if you or rick grove were expecting gratitude for the new bump in substitute pay you're not going to get it because you don't deserve it 250 dollars was not an original idea from you rather you were just piggybacking on the example already set by other districts it's a little bit like plagiarism finally my last point this evening is to remind you once again of a still incomplete and overdue records request made in 2019 this refusal of yours to tell the truth when prompted is exactly the kind of thing that got you into trouble with the pacific rim punitive damages judgment
028you do have the authority to enter rick grove's office in search for the records he has been hiding it reminds you once again and on the record that your hr guy does present himself as some kind of sadist good evening i think your next caller is 9915 please press star six to unmute in the district and i have three children that attend schools you are cutting out could you start again and would you start his time again please are you there can you hear me clearly now yes now we can hear you okay sorry it must have been my uh airpods um i did have a couple of concerns to address my name's jay hopson i live in the district and have three kids that attend one of my two of my kids tried to
029the um exercise their right to be unmasked and at one school she was left out in the rain but she's also been being marked absent when the teachers told them if they're doing their google chrome book chrome or google classroom work which is the same stuff they would be using if they were at home doing school from home and exercising that right but they're being marked absent for being at school but i also have a child who is at pac rim and at pac rim all the kids who choose to not be masked are put in an indoor classroom so my question is if it's to protect the children and the students from from a dangerous virus from mass that do work then and if that is what the purpose is then the school is
030deliberately putting unmasked kids in a room with other unmasked kids which is deliberately by their policy putting them in a dangerous situation so my question is or my statement is it's either about protecting the children or it's about segregating and making and making a point and being punitive because if at one school they're allowed they're supposed to be indoors but it's dangerous putting them in there is putting them deliberately in danger and they're under your responsibility to keep them safe when they're at school and there's a discrepancy between the schools because i was told by both principals something completely different so i'd like for the there to be some clarity between the districts or between the schools and if one school is acting outside of what they're supposed to be acting out of that that
031that that would be addressed and that um our children if they are doing work at school on those chrome books and their chromebooks die the principal told me they will not provide any accommodations for kids including power to charge them i asked them if the kids in class are allowed to they said they accommodate kids who are masked in class they will not provide any accommodations for any unmasked kids under any circumstances and that's word from word from from the principle so um if it's not punitive then things need to change thank you and our next caller is five three six seven please press star six to unmute my name is doug oben shane i have a son at aviara oaks middle school and a daughter at pac grimm dr churchill thank you for your
032comments earlier i realized that you do not have the autonomy to set the coveted rules and i'm genuinely grateful that the staff took the time to meet with cd8 cdph recently like every other parent i have no ability to get such an audience you are all i have for a voice but i note that what you requested was quote a public health road map with timelines metrics and rationale blah blah blah unquote now i'm only one parent but with all due respect if i could meet with them what i would request is nothing less than the complete elimination of all of the following that multi-colored four-page covet decision tree mandatory coven testing of any child responsibly kept home from school by their parents for a day due to a stuffy nose 10-day mandatory quarantine periods
033close contact messages cluttering my email daily staff wasting their valuable time on contact tracing and of course mandatory masking i believe all of these restrictions have outlived their usefulness they need to go and they need to go now frankly at this point i trust my fellow parents to make responsible decisions about the health and safety of their and our children far more than i trust the cdph or nathan fletcher now i have no idea if my views represent a tiny minority or the overwhelming majority of carl's bad parents but neither do you and it seems you all should know because the board was elected and staff were hired to represent us therefore i respectfully request that you conduct a survey of parents find out what we really want you can do this quickly you can
034do it online you certainly know how to reach us as you seem to do almost daily then share the results and if there is a reasonable consensus as to what your constituents want whatever it is the next time you meet with cdph please don't ask them for more convoluted bureaucratic gobbledygook instead tell them what we want be direct and be firm advocate for us please you are our voice thank you and our next caller is seven two zero four please press star six to unmute color seven two zero four please press star six to unmute hello hello can you hear me yes we can yes we hear you thank you hi my name is jennifer belnap i reside in the district i have two cus two cusd students i've heard it said that there are
035three kinds of people in this world those who make things happen those who watch things happen and those who wonder what happened earlier this year governor newsome's lawyers argued in court for a judge that cdph has not mandated math squaring the state lawyer said cdph simply gave a masking guideline for counties to follow similarly if you look at the stipulations for receipt of cares act esther iii funds the word mandate or phrase math mandate does not appear anywhere on that document words matter because words have meaning roseville and eldorado have announced plans to amend almost immediately their policies for mandating mass those school districts will no longer include enforcement of mask wearing but rather will focus on education which makes sense because if you follow the experts you will find that the who has serious
036recommendations to not mask children some people have wondered what happened how did we get here our school board under the direction of superintendent churchill continues its approach of watching for more or new guidance by cdph and watching for more or new guidance from wilma wooten but students and parents in our district and our community have been working hard to make things happen putting thoughts into action is really what education is all about so while this board and dr churchill continue to watch and wait please consider the high cost of your policies for a virus that school children have a 99.98 survivability rate of they are not resilient enough to withstand the long-term damage from harmful and ineffectual policies put in place by government officials that do not properly weigh the cost-benefit analysis they are however
037largely resilient enough to survive the coven-19 virus thank you our next caller is 9976 please press star six to onion yeah this is clayton white i reside in the district have two children that go to schools in the district i i am shocked that we are putting prisoners and children in the same category and if that doesn't shock the the board members here then we need some serious discussion further about how you guys rectify that i'm going to read off of the california school board association website under the role and responsibilities of the school board citizen oversight of local government is cornerstone of democracy in the u.s school board members are locally elected as public officials we locally elect you just remember that when elections come up again entrusted with governing a community's public schools
038the role of school board is to ensure that school districts are responsive to the values beliefs and priorities of their communities by my count 70 or 80 percent of the people that are on this call are talking about unmasking their children and so i would reflect back on that as a member of the school board to the values and beliefs and priorities of their community this is your community telling you very clearly what our priorities are boards fulfill this role by performing five major responsibilities setting direction which you haven't establishing an effective and efficient structure which you have not providing support which you have not ensuring accountability which you have knocked providing community leadership as advocates for children the school district and public schools which you have not these five responsibilities represent core functions that
039are so fundamental to a school system's accountability to the public that they can only be performed by an elected government body authority is granted to the board as a whole not each member individually therefore board members fulfill these responsibilities by working together as a governance team with the superintendent to make decisions that will best serve all the students in the community so i would reflect on that and as a reminder in california it's the largest public school system in the nation with over 6 million students that's a collective student body larger than the total population in many other states where we used to be a beacon and an example to the rest of the country and we're clearly failing by falling on our face and not setting up standards and following the priority beliefs and
040values of the community thank you thank you our next caller does not have a telephone number displayed only identified as call-in user underscore one please press star six to unmute hello can you hear me can you hear me yes we hear you go ahead hi my name is kristen foster and i have one student left in carlsbad in the district dr churchill and board as you have obviously heard students are protesting the mass mandates at each of our school sites the students have been made to sit out in the cold and not participate in class because they are tired of covering their faces if there is anything the last two years have taught me it is to read between the lines and listening to dr galey throw out an arbitrary date of february 28th to
041revisit the math mandate on kids brought back so many memories of dates given and dates pushed back for reopening our schools it was the union back then and it's the union again so tonight i would like to suggest that on the 28th you the board are ready to make the change to mass choice union workers can get vac boosted wear a mask if they choose sit behind plexiglass sterilize everything in the classroom and turn on the expensive air filters that we had to have in order to open if they choose to do so we've known all along that cta is running the show and here we are again waiting to take off masks one of only five states still masking kids it's ridiculous please be ready on february 28th to immediately move to mask choice
042math should never have been put on our kids faces to begin with because they do not work if people want to believe they do then let them choose to wear one but unmask our kids on the 28th thank you thank you and our final caller on non-agenda items is caller two four eight five please press star six to unmute hi my name is um travis spengler i'm the father of two daughters in carlsbad unified school district um i just want to talk about a personal story i grew up in encinitas um but i was afraid of sharks i had an irrational fear of sharks probably saw jaws when i was way too young anyway despite the infinitesimal odds of me actually dying from a shark attack i was afraid to go in the water for
043years and years and years though the infinitesimal logs are very similar to the number of kids who died of coven the difference is i didn't force everyone else to stay out of the water and i certainly don't project my completely irrational fear onto my children do i worry when they go into the ocean and potentially line up for a shark buffet of course however like i said i realize that my own fear is irrational not backed up at all by any data or statistics but what we're doing is we're creating an entire generation we'll be scared to death of going into that water they'll be terrified of any hazards in life no matter what the statistics are those in power have reluctantly been forced to admit what an abysmal decision it was to close the
044schools when will they realize that masking our kids should be retired at the dustbin of history as well i know that this decision will come with its downsides no not from covid but there will undoubtedly be some political backlash and some angry emails and phone calls from some parents but that's an incredibly small price to pay for what our children will gain you don't represent these help the health authorities and their nonsensical mandates you do not represent the governor or the legislature either you don't represent the teachers or their union you don't even represent us parents you've been elected your positions to look after the best interests of the students in this school district it is their well-being that you have been chosen to represent so let's all stop being afraid let's dive into the
045ocean hell i'll even jump in with you let's do what's right for our kids take off these masks thank you for your time uh thank you uh and thank you uh board members for your indulgence i meant to say each one would be one and a half minutes not two and a half minutes but i i i i think it was a good idea to go ahead and allow the two and a half minutes we will now move to item 6.1 the approval of the consent calendar all matters listed on the consent calendar are considered by the board to be routine and will be enacted by the board in one motion there will be no discussion on these items prior to the time the board votes on the motion unless members of the board staff
046or the public request specific items to be discussed and are removed from the consent calendar now is the time for public comment on this agenda item ms garcia please call for public comment on items on the consent calendar if any member of the public wishes to provide public comment on the consent calendar now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item and we do not have any callers trustee williams has requested that we pull item 6.4 trustees are there any additional items to be pulled seeing none me i have a motion to approve the consent calendar with the exception of item 6.4 so move jones second pearson trustee jones made the motion trustee pearson seconded the motion ms garcia
047please call for a vote trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes that passed unanimously may i have a motion to approve item 6.4 so move jones second rawlings trustee jones made the motion trustee rawlings seconded the motion is there any discussion do you want me to state why i pulled it yes please okay so i pulled this item from a 6.4 from consent because i will be abstaining from voting on this item city of carlsbad and palomar community college are listed on the po register my company works with both of the organizations while no material conflict of interest exists out of abundance of caution i want to avoid the perception of a conflict of interest thank you thank you miss garcia please call for a vote trustee
048jones yes trustee williams abstain trustee rawlings yes trustee pearson yes trustee williamson yes the pat the vote passed for in favor and one abstention thank you we now move to part seven which is discussion action items we begin with item 7.1 census 2020 and trustee area redistricting public hearing presenting presentation of maps and resolution number 28 2122 adopting a map of trustee areas trustees this is a discussion action item i will now hand this item over to dr churchill who will then introduce mr chisholm of cooperative strategies great thank you trustees this evening as you just heard we're doing a couple of things looking at draft maps holding a public hearing and then asking the board to make a final determination to adopt a resolution um we will uh go in the following order quick
049overview right now mr chisholm will come up next public hearing board discussion and then we'll move to a resolution uh just as a quick background we retained the services of cooperative strategies to perform a demographic review of our 2020 census data that's required every 10 years at the december 15th board meeting uh josh and his team presented their demographic analysis uh and trustee area change process timeline to the board we accepted public comment and the board did direct the firm to develop several draft maps for consideration on january 9th we posted three draft maps to the website and asked for feedback via an online form at the january 19th board meeting cooperative strategies presented the three draft maps held a public hearing reviewed the feedback that was submitted via the online form following that the
050board had a discussion and directed staff and cooperative strategies to create two updated versions of map one which were labeled map 1a and 1b we posted those to the website on january 25th and included an online form for public feedback we did not receive any feedback via the online form tonight mr chisholm will present the two draft maps uh here and again we'll hold the public hearing to ensure that folks can share their opinions with us a public feedback process as i went over it you can see that there were multiple touch points for us to share publicly listen to public feedback and again but we did receive feedback the first time we posted the maps online the second time we didn't get any feedback submitted via the web form so uh again mr chisholm
051followed by board questions we'll then take public comment via public hearing and then for discussion and ultimate approval of a resolution and then we'll recommend that the board select one of the maps for submission to the registrar voters and without further ado i will hand it over to mr chisholm all right dr churchill thank you uh good evening ford and community thank you for having me this evening i'll pull up the presentation here okay uh and that was a great introduction from dr churchill so that'll help us kind of uh move through this a little bit quicker with the overview um as we mentioned we were here in december and we're here again in january to look at map scenarios and here we are tonight on the 16th of february to review the scenarios 1a
052and 1b we'll talk about those a little bit more detail here further into the presentation and then we'll look for the board to adopt one of the final trustee area maps here this evening once we have this we will work with the county registrar voters to get them the information that they need for the november 2022 election season and we will include the final pdf file as well that we'll provide to the district all right so map scenario 1a for those who were here earlier in january or were here in december we discussed we looked at a handful of maps in january and scenario one a was developed out of scenario one so this is kind of the progression uh that we take and uh i won't cover what scenario one was but in scenario
0531a we had several areas where the trustee areas could be cleaned up and so compact and contiguous trusty areas are something that we shoot for and we had several areas that we felt like the board the community felt like we could clean up in certain areas we could use major roadways uh to to keep those communities of interest together uh and so one of those examples was in trustee area three in the instrument boundary we were able to use el camino real as uh the eastern boundary there and you'll see that here on the map but scenario 1a does have the lower of the two variances it's 2.7 percent uh if you recall 10 percent is the threshold in this process and so certainly we're well below that threshold on scenario 1a and just as
054a reminder the most popular variants for the most populated area which is trustee area 1 plus the variance for the least populated area which is trustee area 2 added together is what gives us that total variance and so um just to point out this would be you know uh simple math this would be two point six percent um if you if we were to bring out the decimals it would be rounded up to 2.7 percent and so that's uh just a rounding error there but the number is if we we're to extend them out the key here is we're well below ten percent okay uh here's the map for scenario 1a um and here is el camino real and there was an area up here in the northeastern portion that was brought back uh this
055red had crossed over east on the east side of the roadway here we moved that back to green so we have a nice uh clean boundary on the western side of trusty area 2 or the green and then there's an area from here and the northern portion trustee area three that was that was converted into trustee area three as well and so those were the major uh changes there were a couple areas that we cleaned up using some of these major roadways as well but overall these couple areas up here were the major changes that we saw in scenario 1a okay here's the demographics behind scenario 1a and for those who haven't been following along again the intent is to have as equal number of inhabitants in each trustee area as possible and with the
0562020 census data being released we have to go through this process to evaluate the current trustee areas that were adopted in 2017 when the board transitioned to by voting areas and ensure that we have equal inhabitants or as equal as we can across all five trustee areas and so we take this total population number of 78 000 who did we divide it by five because that's how many areas we have we get a target or an ideal trustee area size so this is 15 600 people that we're hoping to have we're shooting for in each area and then we get our variants right so in this this row here we have two two data sets for each trusty area we show total population and then we show citizen voting age population and those are the
057citizen voting age population this is a voting act of voting and so this is good indicator for us to understand the distribution of the population uh within each trustee area and the toe yet the total population is really what drives this process uh and what we really have to hold to so that's why you see n a in the variance column for cvap and you actually see numbers here in the total population these are the drivers and so with that below the population variance again for those who haven't been following along from here down show the different ethnicity groups within the district and within each uh column shows the distribution so of the total population within trustee area one the hispanic latino community makes up 23.1 percent and 19.3 percent of sitting citizen voting age
058population and so that same logic uh follows through all the way through this uh table here all right uh scenario one b uh if uh for those who were aware with us through this process was originally uh titled exploration draft c and we discussed um renaming that to scenario 1b so now we have scenario 1a and 1b to clean up and we got rid of a handful of other maps that were not sufficient for boarding the community and so here is 1b in this the northwest corner trusted area 5 which pushed west as much as possible keeping that balance population we did use major road roadways again to create those boundary lines so there were several areas that exploration draft c that was created um in general did use those boundary lines uh uh from
059the beginning and so that's really where this one came from and lastly uh adjusted the boundaries to make trusty areas more compact and contiguous oftentimes using these major roadways helps us keep them compact and contiguous so in 1b we do have a higher variance 8.3 percent but this is still what i would consider comfortable comfortably below the 10 variance um we have had some districts that are in the mid to upper nine percent uh decide to re-redistrict and balance down but uh below below any eight percent eight point three percent is comfortable from our perspective and you can see that the drivers are here are trustee area one and trustee area four that are creating that total variance there okay so here's the map um this one doesn't look look a little bit different and
060we have a comparison slide for the board in the audience here at the end of the presentation that shows both of them side by side so you don't have to flip back and forth but you'll notice a little bit of difference up here was was in the red in scenario 1a and that also included the the school here but in this scenario 1b this is trustee area 2. it just it does come over on the left side here but overall still very clean compact areas when you look at it as a whole we have we're comfortably in the variance that we need to be below 10 percent and you'll notice here with the data that uh the hispanic latino population highest trustee area is in trustee area one uh cvap total population and at just
061under 20 percent for the cvap and as i mentioned before i'm not going to go through the logic behind the table on this slide but it follows the same logic and you can see again here that population variance is driven by trustee area 1 and trustee area 4 being the lowest and the highest and the most populated all right so here's that uh slide i was mentioning scenario 1a and 1b side by side as i mentioned you can see kind of a difference here on the northern side of where trustee area 3 is and then also here on the north northwestern side this was in 1b it was made uh was made to syria 3 or red here and so a few few other changes down here in the bottom but overall not uh you
062know i think we certainly found that the board and the community were gravitating towards uh this layout overall and and uh that's pretty typical for what we're finding across districts though the final maps do end up being pretty similar uh just because we find that uh that consensus among the the crowd to agree on uh a handful of maps your ladder pretty similar so uh with that i'll turn it back to the board with any questions thank you very much mr chisholm our board members do you have any questions uh ms rawlings thank you um whichever map we decide will we be able to have those more specific maps with census data and the roads um in a broader text once it's completed we can provide a larger map that has more detail in the
063map certainly can we also get the census data as well we can yep we can add that census block data on there as well thank you uh president williamson would we need uh thumbs for that yes once we get to the discussion phase we can certainly have that discussion thank you see no other questions um now is the time for the public hearing on this agenda item ms garcia please call for public comment if any member of the public wishes to provide public comment on agenda item 7.1 now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item and there are no callers thank you trustees we have two options before us which is a somewhat unusual situation since we can't
064have a discussion until a motion has been made using the prescribed language from staff i'm going to ask someone to make a motion that we approve map 1a so we can discuss the matter after our discussion i'll ask ms garcia to call for a vote and if it passes we'll move on to the next agenda item if it doesn't pass i will then ask someone to make a motion that we approve map 1b and call and then have a discussion and a vote so would someone please make a motion that we select map 1a and approve resolution number 28-2122 adopting a map of trustee area boundaries so moved jones harrison second trustee jones made the motion trustee pearson second seconded the motion uh any discussion ms jones thank you president williamson trustees tonight i will
065be voting in favor of map 1a in support of the fewest changes and the lowest variances as i believe this honors the extensive process the district and our constituents went through to develop the first set of maps in 2017. i appreciate the work of mr chisholm and the cooperative strategies his partners in helping us through this process as well as those members of our community who have taken the time to write in and email us to render their opinions uh through this process thank you thank you miss jones miss rawlings thank you i will be voting against map 1a even though if it does pass it will not it won't be that big a deal to me i do prefer map 1b just because i do think the lines are cleaner and it does go
066along more major roadways and i do at some point before we pass and move on i would like to discuss the quality of the maps that we will receive and what will be public when it's appropriate thank you ms rollins mr pearson all i would add to trustee jones comments are that i'll be voting for 1a because the uh neighborhoods of interest are being held together and i think that's really critical in the process thank you um i will also be voting for uh map 1a for the same reasons that ms jones mentioned thank you uh so this it looks like we have three votes so let's have a discussion um so i believe that ms rawlings you would if i can just kind of paraphrase what you are asking for is that you want
067more details so that it's very easy for the members of our community to know which trustee area they in which they reside and and if you could maybe explain your census request we received um one of the maps that had census data so um it we were it was easy to see where the neighborhoods were and where the concentration of populations were as it relates to trustee areas as well as to the schools within that trustee area so the only reason i was wanting that is so folks kind of know where their populations are and where those populations are coming from as it relates to school boundaries as well as trustee boundaries and so i'm not saying that we just have one map i'm saying that the public facing map would have more detailed roads
068but then there would also be the census map available if somebody wants to see it and it would be maybe on a back tab um to so it would be available mr chisholm could you respond to the request regarding the census mount yes ma'am we can provide we can print the pdf files when we when we export the map from the software we can print them in a way where their sized and scaled for a 36 by 48 map and if we do that we can provide more detail for the community so we can include the small roads layer and we can also provide census block boundaries and within those census block boundaries we can provide the number of total populations who lives within them a bigger map can provide that kind of detail these
069small maps like we have to present with on the powerpoints you can't see it'll just be jumbled but we can certainly provide that it's easy for us to do we're happy to do it before i ask for a consensus dr churchill i see your hand thank you yeah i was just going to add one one thing to the conversation here and that is and i think it's a good idea that mr chisholm provide the pdfs that have greater detail on roads and the census blocks that that's all useful information but on our website and i'm just going to share here with you right now what we have um a an interactive map that any member of the public can can log in and look at um that describes our trusty areas you can enter your
070address and it'll home in right on your home and it'll show you which elementary school you're zoned for uh which middle school you're zoned for and and what trusty area you're in and when you zoom in you know you'll you'll you'll go down here and get exactly the uh the level of detail that you're looking for so so that exists on the website now and uh will continue to exist for for any member of the public to be able to review and view thank you very much mr pearson you're muted thank you thank you i don't know if this question is for dr churchill or for mr chisholm is is this an incremental cost to do this additional work for the map that ms rawlings requested no we would not charge anything extra for the
071map thank you uh mrs rawlings yes um dr churchill when you show that interactive map number one how does it show uh trustee areas in the larger map and then the map that we show for trustee areas is there a reason why we don't have that map in its place currently so sure so this um decision insight is the the web service in the background that's generating this for us um and we use this for a variety of things you can find elementary middle high school uh boundaries as well um and and so so it's it's useful uh for let me take a step back the original purpose of this map was for people who were new to carlsbad to put in the address of their new home and see whether or not they were
072living in our district and and what their elementary attendance boundary would be um and i realized i'm i'm pointing around on my screen but i'm not projecting so you can't see it showing them there's a there's there's an overlay however so you can see uh different things so um since decision insight which generates that for us could also overlay uh trusty areas we thought doesn't that make sense to have it all in one spot so so that's why we're using that we do however um also put the pdfs so onto the website so that anybody can find those as well and dr churchill just want to clarify we do not have boundaries for our high schools i know that that was a slip of the tongue we i don't want to start a false rumor
073that that that that's in the offing so just no ma'am thank you let me be clear uh we do not have boundaries for our high schools we do for our middle schools and elementary schools thank you thank you uh miss rawlings that's a follow-up yeah i had a follow-up because the map that you showed dr churchill if if i pull out and i look at the entire district it does not have trustee areas um laid on that current map does it um it does let me let me project it again i'm sorry so here you go so so i zoomed way out so i can toggle the trusty areas on and off here's the district boundary in gray here's the elementary attendant zones for example toggle that off toggle the trusty areas on and these
074are our five existing trusty areas i see thank you okay uh so if i could see a show of thumbs those who want to um uh dr churchill would you uh share with us what the ms rawlings request was to mr chisholm so we know what we're doing thumbs on yeah so so we'll provide two additional maps uh one with more detail down to the street level and one with the census blocks included would you show thumbs board members if you are in support of that request i can only see three at a time okay thank you that passes unanswered ms garcia would you please call for a vote trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes thank you very much and mr chisholm thank you very much
075we appreciate uh the all the work that you did on this and thank and thanks staff um we will now move on to action item 7.2 approval 2022 23 lcap timelines for stakeholder engagement and stakeholder survey i'll turn this over to dr nye thank you president williamson williamson trustees and dr churchill tonight you have before you three exhibits these are all consistent with the 2022-23 lcap process and our continuous improvement process exhibit a is specific to the timelines and stakeholder engagement for the 2020-23 collection process exhibit b is the stakeholder engagement survey that we'll launch and exhibit c is our some minor changes to our continuous improvement cycle that we use every year um this has been vetted by the lcap subcommittee board members which consist of trustee williams and trustee williamson we met earlier
076this month and staff's happy to answer any questions that you might have it is a discussion action item so we'll need you to take action on all three exhibits please and we're happy to answer any questions that you might ask thank you trustee williams then you were muted i keep clicking and anyway ms rawlings yes i did ask uh this question of staff but i wanted to ask the subcommittee if um as you're developing the uh survey and some of the action items within the lcap have you taken into consideration some of the categoricals that have been presented in the current state budget to whom are you addressing that the subcommittee um so i think that's you and trustee williams okay so uh ms williams would you like to respond to that i would just
077say that um sure uh that we did not use the categoricals that we used our present survey that we used last year and all we did was remove those items that didn't that were those temporary questions that we had all right mr pearson this is for dr nye in terms of responses for the survey compared to last i think the last we had a pretty disproportionate amount of students versus the other categories do you see any different way of delivering the surveys to increase the amount of the other stakeholders like parents it's great to have the students but more balanced responses last year i think we saw a disproportionate amount of students just because of um we we really reached out to students more than parents i mean we'll we'll try to do a push
078um again to try to get as many parents as possible i still think we had a good number of parents that were represented as well as staff but we'll continue to try to push out any messaging of the importance of this and and and hopefully get a good representation from both parents students uh and staff ms jones did you have your hand up nope okay um now is the time for public comment on this agenda item ms garcia please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item and there are no colors for this item thank you may i have
079a motion to approve the 2022-23 local control accountability plan timeline one second um stakeholder uh timeline stakeholder engagement process the revised continuous improvement cycle and the stakeholder survey so move pearson second jones trustee pearson made the motion trustee jones seconded the motion any discussion ms garcia please call for a vote trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes uh thank you the vote was unanimous we will now continue to item 7.3 lcap mid-year progress report 2021-22 goals success indicators the supplement to the lcap other lcap metrics and mid-year lcap expenditures trustees this is an information discussion item i'll turn it back over to dr nye thank you president williamson trustees and dr churchill tonight were staffs excited to present to you our mid-year progress report for the 2021-22
080goals and success indicators in our lcap tonight we plan on updating the board and as well as the public on our goals including lead measures which we view as predictors of success ultimately for academic success at the end of the school year each year as i mentioned before this is part of our continuous improvement cycle which you see here we're on step four of a 14-step process to develop and update our board in regards to goals and success indicators each year we have uh three overarching goals as well as many success indicators uh in each of those goals that determine success each year this is goal number one that's ensuring that students demonstrate academic growth and proficiency so that they leave tk through 12 ready for college and career here's our second goal and our
081third overarching goal with their corresponding success indicators and then our targets are listed along the right hand side a staff continues to use the model of the four disciplines of execution which identifies wildly important goals and then identifies lag measures which we term as our success indicators and then lead measures and those are really things that we use to influence the ultimate outcome of some of these goals and success indicators at the end of the year so this is an example of that we use these with our principles as well at each of their sites and they write their goals in this format as well lag measures and lead measures as well as wildly important goals be remiss if i didn't say that um the past couple years have been challenging specifically from a instructional
082services side as well as an academic support side um i've listed out some of those challenges there throughout this process i do want to say that we've tried to keep a laser-like focus on academics and preparing students for that next level i'm especially proud of the work and hard work of our teachers as well as our site principals and our support staff as well as our parents and our students um they've done an amazing job and we're hopeful to uh highlight some of those academic achievements tonight so in regards to goal number one i'll walk you through a few of these and then i'm also joined tonight by uh three of our directors director obset who's our director of elementary education director arius who's our director of secondary education and director evanson who's our director
083of people services who will help present some of this information so in regards to success indicator number one this is we have two we bifurcated this into two specific sections one is the percentage of students scoring higher typical growth in ela and math during the 2021-22 school year and that's to increase so we take a snapshot of their growth from fall to winter and then we also take a snapshot of that growth from fall to spring and we hopefully are increasing the percentage of students that are in those higher typical growth bands from one snapshot to the next so you'll see here that we for math we had 68.3 percent of our students in higher typical growth bands from fall to winter this year um you compare that to the same time last year that
084was at uh 63.1 percent so you see over five percentage points more of students in those higher typical growth points this year at the same time versus last year english language arts we're at 67.3 percent of our students in higher typical growth bands that compared to 65.2 last year then the second indicator the second part of this success indicator is in proficiency so proficiency is just making sure students are at that bar at the end of the year it doesn't take into account growth at all and it's not cohorted data so we took a snapshot obviously in the fall and then again in the winter in the fall 55.9 percent of the students were meeting our math target um at the same time in the winter 57.6 so we saw two percent growth from fall
085to winter there and proficiency rates ela similar about a two percent growth in english language arts from 65.4 to 67.1 and then early literacy which we give to our early readers these are traditionally and grade one we saw a growth jump from 66 percent in the fall to 71.4 percent in the winter so this is uh some of the same data in regards to proficiency rates it's just broken up by grade span you'll see there that we did see good growth both at the elementary and middle school level we saw a slight decline in math for uh reading from fall to winter this year this again is your student growth percentile so this is measuring growth same cohort of students high typical and low growth from the fall to the winter you'll see that roughly
086you know 37 percent of our students were in the high growth band from fall to winter this year as compared to uh about excuse me 36 37 last year as compared to about 39 this year overall it's about a 2 increase in students and higher typical growth bands for english language arts from the winter of this year to the winter of last year comparatively this is the same proficiency rates again but it's just for math we did see good growth in all the great spans in this this area and then similarly as i mentioned before we grew about five percent when you looked at the growth bands from fall to winter last year versus fall to winter this year and again i mentioned before the literacy the early literacy rates grew at about a five
087percent clip one of the things that we did notice in regards to early literacy however is that um students were starting off in a slightly lower place so we did um and at the winner points or the mid-year point they were at slightly lower than last year so part of that had to do with this was the first year last year where we gave the early literacy as well as all of these star exams um so there were some students that were testing that might not necessarily have been classified as early readers they might have been emerging readers already as far as what grade level they were in so but another part of that is and what we're watching is um to see if you know if this is a trend and we're starting to
088get students um literacy rates that are coming to us that aren't to the level that they were in previous years so we'll we'll monitor that as we go forward i'm going to turn it over to director arius who's going to walk us through the rest of the lead measures and success indicators in this goal thank you um our first success indicator was that the percentage of graduates completing a to g requirements will maintain uh 80 or higher and our lead measures included we had 76 of our 2021 graduates enter college upon graduation and we had a 90 persistence rate in college for our 2019 graduates um this past summer we offered high school credit recovery and had over 400 students who remediated a d or f which helps with a to g attainment and credit
089recovery um students this summer had the choice to attend summer school in person virtually or do a hybrid of both sites have really focused this year on increasing the amounts of interventions and supports for students so this has included offering apex credit recovery and a digi attainment during the school year and their schedule i'm offering in-person and virtual tutoring peer tutors math and writing labs counseling check-ins and intervention courses and our sites and departments continue to do the data analysis just with the data you were looking at looking into the star data looking into dnf data and then coming up with an action plan for each individual student and we also added community liaisons and intervention positions who then would meet regularly with the at-risk students and and their families and provide any targeted resources
090and support next slide and the next success indicator was to increase the number of high school students enrolled in at least one honors advanced placement or community college class and currently we have 78 of high school students taking one of these classes our miracosta concurrent enrollment is currently at 361 to date and we continue to offer courses which allow students to get early college credit as well as high school credit through our 15 articulation agreement courses in place with miracosta palomar and miramar and also our four dual enrollment courses with miracosta we also had some new courses this year and some of them included a new architecture and construction cte course at javier oaks middle school where they even built a tiny house this year a new digital media cte course at carlsbad village academy
091and a music technology course at carlsbad high school next slide okay this success indicator was the percentage of all students meeting or exceeding standards on s back will increase by one percent in english and math so some of our lead measures are our college and career ready indicator in achieve 3000 has increased from 56 percent at the beginning of the school year to 63 percent um in january we've been incorporating the implementation of freckle which is an adapted and differentiated program to strengthen math and reading skills we continue to identify students needing more intensive interventions and are utilizing our math 180 read 180 and sunday system programs for that we added a math teacher on special assignment um who's been supporting our grade level teams and also our departments at the secondary level and elementary
092with strategies and professional development and this past summer we also offered summer school for elementary and middle school students as well as high school math students and we focused on the essential skills for math and reading we offered it in three different models and had a total of over 1300 students who attended next slide please and this indicator is the percentage of all students meeting or exceeding standards on the cast science test will increase by one percent um we did have 51 percent who met or exceeded on the 2020 2021 cast we are currently this year evaluating and piloting science curriculum and materials we began this process pre-covered and had to kind of put a stall on it and now we are picking right back up and we'll be piloting both at elementary middle and
093high school levels and these uh curriculums are aligned to the ngss standards in addition to that at the secondary level we are developing common science assessments that are tied to the standards and those are going to be in addition to the other type of assessments that they're currently given and we've continued our professional development with the ngss standards as well and we're constantly looking for opportunities to infuse career exploration into our science classes and so far we've been doing this through opportunities like safari park careers environmental stewardship program we have bck environmental internships now for enviro for elementary middle and high school students and cef has helped to fund many of these opportunities and helps to connect us with some of these partners and they have also funded our steam teachers in our steam labs
094and helped with science lab teas in high school as well the next slide please and this success indicator is the percentage of graduates that are college and career ready as measured by the california dashboard will increase by one percent there is a note there the cci dashboard will not be reporting out a percentage for this school year because we did not have espec scores last school year and many of their metrics are tied to sbac but in our lead measures um all of you adopted the three-year career education strategic plan earlier this year so thank you and we've been working with the committee on implementing those goals in the plan in addition to that we did receive a second year of funding for our k-12 pathway coordinator who's nicole morsch is in that current position
095and we were just recently notified that we also received the new round of strong workforce grant funding which we applied for this year um and that will help get this work done and that amount was for about 700 000 we are increasing the number of career education and exploration lessons and interest inventories at the middle and high schools and we're piloting a career exploration lessons uh using thrively at magnolia elementary and at calavera hills middle school as well and we continue to develop our industry partnerships to bring career exploration opportunities to our students and one of these partnerships this year is with tri-city medical center and carlsbad oceanside and vista chambers of commerce and our collaboration has resulted in a new website that they have developed for our students and families in order to explore
096a variety of careers in and around carlsbad it's called socal which stands for student opportunities for career awareness and learning a special thank you to ray pearson who connected us with aaron bisac at tri-city medical center previously to create these career exploration opportunities and this introduction has led to this great partnership and a very valuable resource for our students and families and the ceo of carlsbad chamber of commerce will actually be unveiling this website for our cusd families at our parent university next week on february 22nd and there's a flyer being sent out as well and that's it next slide thank you all right i'll turn over to director obzid who will cover uh the success indicators around goal number two good evening thank you next slide please um so the first indicator under this
097goal um is providing professional learning and training to our teachers um so that they can um do their instruction better and that all of the professional development that we provide um we do a survey on that to see if it's relevant to their work so a couple of the different events that we have this year we had an august pd day where we have the theme of reconnecting reflecting and reimagining um what instruction looks like just coming off of last year i'm really focusing on you know curriculum but also just rethinking how to connect the the students to each other as well as back to school um and that the different sessions that were offered during that were rated at 95 percent of relevancy um and then we followed up with that at our november
098um pd day kind of learning and applying and reflecting on what they had learned and and anything that um you know was different based on them being back in the classroom for a few months and so again teachers rated that at an even higher rate of 98 and in addition to that there's um both site professional development as well as other opportunities that we provide the little independent learning modules are still available for teachers we do have instructional coaches that support teachers with implementation of curriculum and instructional strategies and then we also have our teachers on special assignment so as you heard earlier we've also added that math tosa that's really focusing on uh those strategies when we meet with like the grade levels and in our departments but then also elementary and and secondary
099tosa as well as ertactosa and they're available to provide individual support office hours they go out to the school sites to model lessons and help the teachers next slide please um so this uh success indicator is um creating our uh diversity equity and inclusion plan or what we're looking at as possibly renaming the cultural proficiency plan um and so so far this year what we've done is we do have our contract with the county office of education um we have had several meetings with them are starting to roll out the process for engaging our families our students and our staff in this process getting feedback from them and kind of developing next steps we've been having ongoing meetings with our district student equity committee um and then really just diving into that data so our
100team is working with the county team to create a data dashboard so that the committee will be able to really look at and dig into the the data around how our students are doing and and if there's any areas that we need to address and i believe i am turning it over to director evanson good evening trustees and members of cabinet uh this success indicator is the percentage of respondents who feel safe at school will increase by two percent for students over the previous year and remain at 85 or higher for the parents the target then is 74 for the students the california healthy kids survey is last year's survey that's the most recent one we have and the results of that as you can see indicate that we are not meeting it yet in
1017th and 9th but we're exceeding it in the 11th however as kosh is going to define a little bit further in a couple slides from now on the kelvin survey those results indicate that we exceed it um in all three grade spans uh for elementary middle and high the five bullets that i pointed out that our contracted safety coordinator has been working on a couple of those i just want to highlight too is that this year in terms of increasing our school safety poinsettia valley and seaside were all selected to participate in the california department of education statewide survey on lockdown in optimal response emergency drills and carlsbad unified held a multi-disciplinary threat assessment meeting with our district administrators including all members of executive council are here tonight next slide so i believe director obviously
102is going to come back and uh do these last three slides yes thank you um so this success indicator is about our parent university and that the topics that we offer the sessions that we offer are relevant to our participants so so far this year we've offered about 14 different types of topics um and still have a calendar of events with other offerings for the rest of the year and the events that we've had so far they have rated 90 or higher um we've listed some of the sessions that have been held as well as some of the upcoming sessions and so really we've just you know been trying to target resources and supports for parents around topics that they've expressed an interest in or asked questions about um such as the social emotional learning
103you know what that looks like so we had harmony come out and do a presentation for elementary and the counselors have put together um information about what they're doing at secondary um and continuing to offer like the parents learning to be better parents um as well as college fairs and career fairs and then just anxiety wellness mindfulness those sorts of topics and then continuing with some of those topics as well as reaching out to parents to find out if there's other things they're interested in next slide please so um this one is about our students that are meeting the profile of the attributes on the graduate profile as measured by our core social emotional learning survey um so those are the the categories there um the numbers that are in bold are our fall baseline
104and then the the numbers to the right of that are the targets that we're trying to get to so we're not quite there um in any of those but we do have a little bit of growth to to take on and then some of the strategies that we have been doing as well as resources um for social emotional learning um as i mentioned earlier like we are doing harmony for elementary and then the counselors have created a curriculum to share during advisory um at the secondary um we did add elementary counselors this year which we have not had at the elementary level um so we have five of those and they share sites and we'll talk a little bit about that i think director evanson will talk about some of the things that they've been
105providing we also added wellness together as a resource for the um students that um are referred to that that need additional support um and then just some of the other activities that we've had in previous years our community partners um really the art and science of well-being course that's offered at the high school um signs of suicide start with hello and say something trauma-informed care so a lot of just resources supports to make sure that students have that connection with each other with their peers as well as with adults and then support and resources and help needed for those students if they really do need additional support or intervention so this is our fall survey of the kelvin survey that's the name of the the company that we are using to create this survey so
106they have a bank of questions and we get to select those and then we give them in what's called a kelvin pulse because it's a quick survey that goes out to the students it is a pop-up that pops up when they are working on their district device um so a little dog comes up and says hey please take this this survey um it's about nine to ten questions depending on the level we had an elementary version and then we had a secondary version um and we worked with our counselors to select the questions that we thought were most appropriate for those grade spans um and then it's usually open for about a week so we've done it once and and it is actually open this week right now for one of our our second pulses
107um so we'll gather data on that um but we ask questions around these these different domains or dimensions so school connectedness the school climate emotional and mental health um as well as for our older kids um that stress and anxiety because we were hearing a lot of that from the the school sites that students were expressing a lot of stress about returning to school or anxiety over multiple different things so you can kind of see the results in each of those areas as well as the number of students that participated um and you know what rate that was with the the data can also be disaggregated by school sites so each of the schools as well as grade level um you know this is sort of the great span but they can pull out just
108eighth graders or what have you and so each of the sites can look at their data and kind of look at like are there different areas that pop out as being strengths or areas that need to be addressed at the elementary level of course that's something that the counselors can look at and then you know create and design classroom lessons around that um you know and similarly to at the secondary so it provides data that the schools can use to provide additional support or make changes or things that they need to do the sites also have access to the the tool um so the counselors can uh create a quick pulse after they've done one of their lessons um you know schools can create the the survey um after they've you know if they want
109to measure something or an activity that they've done it also has the capability of being able to to be used like with parents and staff we have just not explored that part of it yet and i believe i'm turning it back over to director evanson thank you the um contracting agency that cautioned director obset i have to admit i missed her last name up um wellness together that we brought on uh at the end of last year for our two comprehensive high schools and we brought them to all of our secondary schools this year uh is to continue to provide a pretty valuable service at the mid-year we looked at their data that they provided us and of the 135 students referred 81 of those students being referred either received or are currently receiving services
110and you can see on the right the top reasons for the referral and some of the things that director of just talked about with the uh with anxious uh this being that the top reason so if we can go to the next slide thank you we also um brought on our elementary council counselors as you know and this year and equally impactful as you can see on the far right a couple of things uh that they're addressing and a couple things on the left that i want to point out is they're providing monthly whole class lessons providing small group sessions and providing individual counseling sessions and i know that today i had a principal call me up with his counselor at his assigned elementary school and it's uh it's excellent what the service they're providing
111for the student in that particular situation i'm very very very grateful for that student and for the board uh for allowing the counselors there this year because that would not have been addressed the way it was addressed this year with the lack of a counselor all right and the last few items we did want to just highlight semester grades quickly this is a snapshot that we showed last year as students um came back to some in-person learning or or wanted to kind of quantify where we're at in regards to virtual learning and in-person learning so you see here and i know dr churchill had mentioned we had our largest percentage of students receive a's out of the previous four years um and we're back to what i would determine as pre-pandemic levels as it relates
112to you know students receiving d's or f's roughly uh uh with the percentages so last year at this time you know we were at about ten ten and a half percent of students receiving these refs and so we're we're definitely back to pre-pandemic numbers in the secondary level and at the elementary level even more of a rebound i would say uh the highest percentage of students meeting or exceeding standards fours and threes uh than we've had the previous four years so that's those are some good data points um that lead us to believe that we're moving in the right direction as far as grades are concerned and it's one academic you know metric but we think it's a good one to share lastly uh the state is requiring that we also uh take some time
113and update you all in regards to some specific things around the lcap so we've included those exhibits in the um in the board report itself i'm not going to go into those one of the requirements is a one-time supplemental plan and that does highlight how we're spending some of that one-time dollars that i believe trustee rawlings had asked a question on and how that aligns with our lcap goals and success indicators so that plan is really in place to say how are you we using our elo plan how are we using our s or three dollars and and do those did we take into consideration some alignment with our current goals and success indicators in the creation of those um plans themselves now they each have their own separate plans that we still need to
114provide but this is a one-time supplement that just kind of summarizes that data um in a in a pretty concise way the next requirement is this mid-year worksheet and as the trustees recall we have a lot more goals and success indicators or goals and metrics in our lcap than we do in our continuous improvement cycle and what we call our goals and success indicators so there's things like misaligned teachers or teachers teaching out of the credential or requirements around the lcap that we talk about our facilities being in good repair so those are things that are required by the state that we report on those metrics are listed in here as well on a spreadsheet and lastly we are required to give a mid-year expenditure report so we itemized and took into account all the
115expenditures to date that we had currently in our lcap i'm pleased to say that we're pretty on track with all of those and spending those out throughout the course of this year so i didn't see any anomalies there but that exhibit is also provided for you so with that staff has completed our our presentation tonight and we're happy to answer any questions that you might have thank you very much dr nye we appreciate that uh board members it's 7 47 let's go ahead and ask questions and for a few minutes try to wrap it up at eight and if not we will uh maybe go a little bit longer than eight and then uh take a a break we will start questions uh let's just try to do one at a time with trustee jones
116followed by trustee williams trust followed by trustee pearson thank you president williamson my first question is for director evanson i don't mean to surprise you with my question of course but do you happen to have handy with the student referral rate to wellness together was for the same time last year i'm aware i'm muted yes you you did surprise me and no i don't we didn't bring them back until we didn't bring them on board until around this time last year so i would have to get the numbers at the end of the year i can give those to cabinet um hopefully by the end of this meeting because i do have that data as well thank you and i'll get that for you i'll give that to cabinet trustee williams thank you president williamson
117um it was for slide 28 on the fall kelvin survey i think it was for director upset um why was the participation rate so low and in the high school yeah so we were surprised by that as as well so we um you know thought it could be the survey was like right before uh winter break um and so students may just have been overwhelmed with the time of year um and not participated um usually before the survey will send something out to staff so that they're aware that like hey you know if this little thing pops up make sure your kids take it and so we'll we'll make sure that we address that um for this next pulse okay i appreciate it thank you while we're on that slide let me just quickly ask
118stress anxiety do we want a high number there or a low number i'm not sure what what our goal is um so i think a low number is good so the middle school's being at 46 because the way the question was worded um was you know i feel anxious at school all the time or you know something to that effect um and so you know the high school one is concerning because we don't want that high number so a lot of those students are reporting that they felt anxious or they felt um stressed um so that's information that's good for the school so that you know there's something that they can do about that and then the middle school one was a lot lower still high um you know about half of our kids are
119saying that they're anxious or or um reporting that you also saw that in the wellness together that was a lot of the the referrals that were for that um so you know there are things being done um and then again we didn't ask that question at elementary um just felt that the students may not quite understand how it was worded so we didn't ask those those questions but you know if students aren't experiencing that our counselors are handling that okay thank you my question is also follow-up yeah yeah i got the gist of that was i didn't know if we were wanting a higher number or a lower number because then all the other items that looked like a higher number was preferable i didn't know how the question was worded so the answer is
120that 46 means less stress and anxiety not more is that correct is the same true for emotional mental health thank you yeah no that one you do want the high number the way those questions were were worded and we can share the questions with you if that would be helpful um we we have all of those questions so yeah thank you if you could share um mr pearson is your question about this question no and i'm just here okay trustee rawlings yes um my question is is um how does the uh healthy kids survey participation uh compared to the participation levels listed on this slide yeah i don't i don't know off the top of my head you know we we gave this to all students in these grade span grades fans you know healthy
121kids survey is only for a specific grade span so but i don't know participation rates and how that how that compares we could certainly get that information for you if you'd like mr pearson i believe it's slide 17 on miracosta college concurrent enrollment i think yes it is okay so just a year-over-year comparison and i know to date it's 361. um this time last year was it about the same greater or lower just to see if there's a trend yeah i don't know i haven't last year we were at um 414 at this time of year so it is lower now miracosta has been virtual this whole time so i know that many of our students wanted to get back to in-person learning that might have contributed as a factor of why they didn't enroll
122um but we will we do meet with miracosta and we'll be seeing if they they have any information on that as well but it is lower than normal ms jones thank you president williamson um i think this is for um director arias or dr nye do we examine or capture why more students are choosing the alternative graduation path so that we learn the reason and and the follow-up is are we finding that the increase in the number of graduates choosing an alternative path are heavily representing subgroups such as ell foster homeless or low socioeconomic yeah every student that does choose an alternative graduate plan meets with a counselor they fill out that contract we do look at some of the reasons why they're doing that i would say predominantly it's because they have aspirations to
123attend a trade school or a community college directly after high school as far as the demographic data i'm not certain that we're tracking that at this point in time i don't know director aries do you know if we track that on the um i have not seen that i don't know if sites have that can be something as we work with the county and analyzing some of our data that they're collecting for equity that could be something that we add to it i also know just over last year and this year um you know there was ab104 which also allowed some flexibility for students who are not on track to graduate to actually um get to look at the state requirements for graduation this is this will be that last year for seniors because of
124um just the challenges over the last two years so we anticipate that some students might still opt for that but we don't have solid numbers yet because as we continue to work with the kids the whole time to really try to get them to our graduation standards and a to g but some might be more looking at into that piece of legislation for some of the graduation requirements as well thank you um are we planning on continuing uh providing hybrid and virtual for summer schools in the future or is this the last year for that um now for this coming summer school we were going to again offer it it was actually the virtual was very popular and the hybrid i think because students just have more flexibility to get to go on a family
125trip and not be tied to going to the in person um you know if there were any students that were struggling virtual or hybrid they could they always had that opportunity to come full time in person and and some were moved over into that so we do plan to offer all three options for high school credit recovery again this summer ms jones yes um my next question is uh for dr nye and i'm sure one of the directors could answer as well but do we have an indication of the progress for statewide s back or testing when that might return have you received any indication aspect testing is going to return this year we're in the midst of alpac testing now um and sbac will return in the spring of this year so is it
126a full battery or is it a modified version or yeah um we're still getting more information on that but i believe it it will be pretty close to the full battery i've heard different things about the um performance tasks that students have had to take in the past and maybe there are some abbreviated versions of that but um no to our understanding it would look very similar to what it's looked in previous years thank you free pandemic sure ms jones do you have any more questions or uh or was that that was my last one okay all right thank you very much seeing no other questions uh thank you it's 7 57. let's go ahead and take a five minute break or let's let's go till and then we will come back for public comment
127thank you trustee williamson you are not on mute you are not on mute thank you it's 805 and we are now back in session now is the time for public comment on this agenda item ms garcia please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item and we do not have any colors for this item trustees now is the time for discussion is there any discussion ms jones thank you president williamson i just wanted to lead out the discussion with some positive thoughts um there were many lead measures that i wanted to say that i was pleased to see us
128tracking and and i wanted to also say how proud i am of the caliber and achievements of our staff in the school's libraries i also want to thank the instructional staff for providing such relevant and timely parent university sessions i've personally received very positive anecdotal feedback from parents about the subject matter and gratitude for the timely topics that you've offered so thank you for that some additional thoughts i i have are that it's encouraging that we're seeing continuous improvement in core subjects like of course math and english parents are telling us to focus on math reading and arithmetic which we are and it shows in our scores i'm i'm proud of that i continue to get i continue to get concerns um that for some students it's difficult to have access to math tests following
129their exams in secondary school which has been a concern particularly as they recover learning loss i want to continue to advocate that learning from mistakes and math is an important way to improve your math skills i also want to share that there continues to be uneven use of google classroom for turning in assignments and homework organization which has been expressed as a concern to be able to improve to continue improving student grades so i just wanted to advocate for that again as well with staff but thank you very much for the presentation dr nye and our wonderful directors i really appreciate that we're being diligent we're seeing results pay off ms jones are you asking for us to get consensus to direct staff regarding your concerns uh we already have a consensus on the google
130classroom platform from a prior board meeting i was just simply reiterating my advocacy for that uh we i i wasn't going to make a request because i hadn't spoken to dr churchill about making requests for math but i can certainly add it to my list okay all right if you perhaps want to discuss it with him and then maybe you could bring it up at the next board meeting um in governance requests or if you wanted to do it now it's up to you thank you ms rawlings thank you um i just wanted to say you know again thank you uh to staff for all the hard work here i mean this is very comprehensive information and and very useful as we move forward in developing the new lcap for the next year um the
131one thing i did notice is the it does appear that the fall kelvin survey does seem to have a lot of participation it seems to be we seem to be getting better data so my hope is is that as we go into discussion in developing the new um el cap that we might want to look at the the kelvin survey as maybe a replacement for the healthy kids survey um it just seems like we're getting better and more useful and increased data that we're looking for is there any other discussion ms williams thank you no i i share the same sentiments with trustee rawlings in terms of that um my only worry or not worry concern is i know that teachers are counselors are changing the questions so i don't know if it's an equal
132survey for every if it's every level grade level or elementary so i'm so i want to make sure we're we're calculating or we're looking at the numbers that that that are equal or the equity of the equitable um they're equal so that's where i the only concern i have that but like you're saying to having a discussion next time for no cap thank you if there's no other oh ms williams are you okay uh if there's no other discussion uh thank you very much dr nye and directors arius opposite and evanson we appreciate all the the hard work that you do the focus of our school is students and so we appreciate the all this work we will now move to item 7.5 the annual audit report for fiscal year 2020-21 this trustees this is
133a discussion action item and i'll hand it over to mr dill i think we stole item 7.4 did i miss 7.4 oh i'm sorry yes thank you trust this is number moving to 7.4 this is an information discussion item mr dill just know i was ready to go right into the audit reporter sorry about it thank you uh president williamson uh in december the board asked that we provide an update on operational issues with the nutrition services department and what we face this year joining me this evening is director of purchasing and nutrition services carissa iwamoto we'll get to the report in a moment but i'd like to provide a little bit of context before we get into that we are serving more students than we ever have in this district as you'll see we're
134on track to serve nearly 900 000 meals this year and we are the only restaurant in carlsbad that's only open for half hour a day we're doing this at a time when the disruption in the global supply chain has had ripple effects on us just like any other food provider we've been short on food and supply inventories deliveries were missed orders were shorted but we provided a lunch to every student who came through the line this year we've also had to face the same challenges with labor shortages while employees were out sick or if we had vacancies to fill but uh in spite of all of that we persevered and and we're having our best year ever and so i would love i would like to commend our classified employees in nutrition services and the
135warehouse who have worked so hard this year and actually since the first days of the pandemic and every other classified employee who stepped in when we were short on staff to make sure that all kids were fed so because of this hard work and under uh adverse circumstances as i mentioned we are poised to have our biggest fear ever and we could not have done it without that without them so with that i'm going to turn it over to ms iwamoto who will give a brief report on the challenges we've faced and how we are going to focus on improving the program as we continue to grow so i'm going to run the slides so given just a moment i'll bring that up thank you so much thank you members of the board and members
136of our community and cabinet i'm honored to be here tonight and i will be sharing a little bit about our program and thank you so much for that introduction mr dill so first i wanted to just cover some of the benefits of universal feeding we as a department exist to support the learning that's happening in carlsbad and universal feeding extends our ability to do so another great benefit is that this creates a new financial landscape nutrition services is able to be self-sustaining and also we no longer have the burden of negative balances applied to the general fund you may recall before covid senate bill 265 addressed alternate meals and heavily indicated that unpaid debt would be a general fund responsibility so we're pleased that universal feeding has alleviated that lastly this is a great opportunity
137for parents to experience a convenient option where the restaurant comes to the student and it's safe and nutritious food for their growing child so what does nutrition services look like today as we talk through our update implementing universal feeding has not been without challenges we can't serve students without food supply chain challenges have been widely noted in our media outlets and we continue to experience a strain on procuring food and supplies likewise likewise as many employers now are experiencing we have persistent staff shortages which is less than ideal amid surging uh participation but i'd be happy to highlight some of our successes um we've seen increased participation uh specifically this year we've seen an average of about 53 percent year-over-year from 2019-20 and our three-week rolling average is actually a 75 increase so we're continuing
138to grow in our participation we've also been able to adapt quickly while we adapted to curbside service in previous years upon our return to in-person instruction we've been able to consistently offer meals that appeal to our students and are pretty familiar from our menus from prior to covid we've also proactively sought solutions in order to minimize impact on our students and on our frontline staff workers we've done everything from ordering three months in advance to bulking up our warehouse in order to try to preempt those shortages of course our menus may change as needed um in the case of a truck not arriving on time but we try to again reach that planned menu later in the week because we want to have a consistent experience for our students um also we've not had to
139infringe on instructional time again we're a support but we don't want to detract so we're proud that we've been able to accommodate this increase without asking for additional lunch time or lunch periods and lastly while we have had staff shortages we also are proud to see some of our staff promote and promote from within that adds to our knowledge base that adds opportunity and encouragement and it builds staff morale during a very difficult time so we have many blossoming leaders that were just ready for the right opportunity so this slide covers a little bit about our meals that have been provided there's historical data starting in 2017-18 looking through our projections this year as you can see our forecasts show unprecedented participation our warehouse is quite full right now ensuring that uh we have enough
140food and to serve all of our students with these unprecedented numbers on the right you'll see some of our scratch cook pizzas from siege creek kitchen they've been working really hard they've had a couple of days with over 700 lunches and then of course breakfast is an additional 350 or so on top of that so great work really being done in our kitchens then this slide goes through a little bit of our revenue and expenses as you can see it's a pretty dynamic chart but there's historical data there where you can see 2018-19 follows the most typical pattern um it's broken up by semester one and semester two so that you can see the trends um typically you'll see that in the first semester our revenues are lower and that's due partially to just the
141lag and reimbursements which is the model of our of our meal service we get our reimbursements after we've served them um and i believe that was brought up at a previous board meeting as you look at 20 1920 you'll see that the revenue was actually higher in semester one than it was in 2018-19 so we were anticipating a good year however there's a decline in semester two which was due to the immediate shutdown and limited meal service when the pandemic hit our teams were at jefferson starting on march 16th but when we quickly outgrew that location we pivoted to meal service at chs um so we've been serving throughout the pandemic but you can see in these charts where we're the pandemic hit when we look at 2020 2021 again revenues were very low just
142due to the reimbursement lag and that incremental return to in-person learning but we quickly caught up in semester two lastly we close out our revenue looking at semester 1 for 2021-2022 you can see it's a healthy source of revenue that's partially due to high reimbursement rates that were implemented this year as well as some one-time funds when we look at the expense side again you'll see 2018-19 is a typical pattern and a normal shape 20 1920 was a little bit flatter due to some of the absences of our high variable costs when our meal service goes down um also our a la carte items which stocked um in 2019 20. also in 2020 2021 we didn't serve a la carte meals either so the expenses were a little bit lower but we've steadily increased as
143we've seen our meal counts increasing from semester to last year to semester one this year there is a gap that you'll notice between our revenue and expense however we're closing that gap by making strategic increases to staff hours and replacing equipment that simply can't keep pace with our new normal yeah so if i could just jump in and just make a couple comments on the slides it's about money um one this part here where you see the sudden and dramatic drop in revenue that of course came with the uh onslaught of the pandemic the way the cafeteria fund was able to get through that difficult time was through its fund balance and it just stresses the importance of making sure that we have reserves for economic uncertainties in our funds for when we have a
144sudden unforeseen event and of course that was uh probably the biggest one that'll probably ever hit that particular department but it's certainly a parable uh for our other funds as well and and again just to point out this is the gap between revenue and expenditures this is a good gap because we have more revenue than expenditures but as we look to move into the next year again as carissa mentions we'll be buying some additional equipment to keep up with the demand and as we're able to bring on uh either more staff or addition or provide additional hours for the meal production you know those costs will be going up as well so that gap will close and really uh this is not meant to be a profit center it really is meant to be a
145break it even proposition and so that will balance out over time thank you and this slide talks a little bit about our staffing level staffing levels and our meals per labor hour uh nutrition services has some unique nuances so this captures a little bit of that um our department has a range of positions anywhere from two hours a day to eight hours a day so while our fte seems low we have roughly 60 positions at our school sites so this graph on the left captures our fte specifically for school sites as well as taking into account persistent vacancies these aren't one-time vacancies these are vacancies that just are really difficult to fill or sustain and you can see that the pandemic has increased those sustained vacancies and again it's it's unfortunate but we are we
146are very very grateful to our personnel team who continuously help us fill vacancies and i know they are running on on all cylinders right now then the chart on the right shows meals per labor hour that's an industry metric for productivity um what we've seen with our meal surges and the remaining vacancies is that that meal for labor hour is far higher than it's ever been part of our adaptation is food items that can cook quickly so this year really is abnormal in terms of what that meals per labor hour looks like we do anticipate as we find our new normal returning to more scratch cooked meals and a smooth return to that range of 10 to 15 meals per labor hour that's the industry golden standard so now you know a little bit of
147the context of how our department is serving meals a little bit about our revenue and expenditure and the staffing situation i want to highlight some of our current and ongoing goals as a department first and foremost i just want to take a moment to show sincere gratitude to my team as mr dill mentioned we just have an amazing group of professionals in our nutrition department and i count them as my colleagues and this could not be accomplished without them many of our staff members also have had their students go through the district they are dedicated and they are kind my goal is to focus on their insights through regarding meals student preferences preferences as well as optimization opportunities within the kitchen we've gathered survey input that's helped guide procurement and has helped optimize what our
148kitchens are capable of during these challenging times and those who do the work have great insights to share likewise we're looking at matching the staff hours that are available from our revenue to those sites that are experiencing the greatest increase in participation secondly an ongoing goal is to provide meal provide meal variety to ensure that everyone can find food that's familiar with them to them we know that we have uh students with diverse palettes as well as students who opt for a vegetarian diet in our district we directed our procurement efforts for next year to really incorporate more cultural foods and fuel that great learning that's happening at carlsbad unified and here we've got a handful of photos to show some of the great foods that are being offered at our secondary sites in continuing
149the conversation of our ongoing goals we want to continue to revisit sustainability we've integrated more sustainable options like bamboo cutlery at our secondary sites and we've moved away from single-use water bottles as much as possible we also continue to evaluate how we can sustainably sustainably adjust all aspects of our operation to help minimize waste farm to school efforts are also moving forward i'm happy to share that we posted our produce rfp yesterday with strong preference language for local growers and capturing the story of their farm so that we can share that information with our stakeholders lastly i mentioned that our revenue this year includes one-time funds which is allowing us to refresh our old struggling equipment that just can't keep up with this new landscape so we are directing our goals to refreshing put the
150equipment in a strategic manner i really want to thank ms iwamoto uh not only for the report but uh i've seen the work that she and her team do every day and and they really are hardworking and dedicated to making sure that our students are fed and um and have just done it under such incredible adversity over the last two years so uh thanks to you and nikki and and everyone else out at the school sites and with that we uh turn it back to the board for questions thank you very much thank you very much mrs avamoto that was a very um enjoyable account and presentation and i'm now hungry so i just realized i haven't had dinner you know those food pictures reminded me so thank you thank you for the presentation trustee
151do you have trustees do you have any questions uh miss jones and then ms rollins thank you president williams and i was thinking the same thing that broccoli looked delicious uh director eumota do we track um first of all thank you it was a great presentation and i appreciate the update it's always nice to hear from the nutrition services team do we track an average number of meal per student so and or some way to observe if there are students who are exceeding one meal per service yes in fact our point of sale system captures that there's a prompting that comes up to the cashier if the student does try to take a second meal um we do provide that we are allowed to provide that um however only the first meal is free and
152the second meal is charged to them thank you ms rawlings thank you i didn't want to jump in and uh and thank you for the presentation i know that this was something that um i had brought up and um i uh i know this is a huge change um for our district so i wanted to make sure that that we were keeping an eye on it and that we knew kind of what was going on so i appreciate your efforts here and um as we already saw that you have a uh you know rfp posted uh for some of the things that we were um discussing at the last meeting my first question is um you talked about some dietary diversities um what about like food allergies uh milk uh tolerance soy uh you know
153different types of fruits how is that addressed with um the universal meals yeah great question um so any food allergy uh is it will go through the same process the nice thing about the national school lunch program is they do have a standardized process for students who have a documented allergy to fill out a medical statement form and that is available on our website so that anyone can access it as soon as they need we also have printed copies at all of our school sites so if a student indicates that they have an allergy we immediately talk to the student and say we need to get this documented so that basically when they would then put in their in input their number at the point-of-sale system it will flag the cashiers so that they're aware
154that there is an allergy and that it needs to be accommodated mr pearson carissa welcome uh what what what percentage of our produce is sourced from local farmers that's a very good question mr pearson our prior uh solicitation documents didn't ask for transparency in the the regional uh the region that it's coming from however our new procurements are going to be guided in that way i mean you know that california grows a large amount of produce throughout the united states um but i don't actually have a figure because we simply haven't requested transparency on that location that it's come from ms jones thank you um mr dill on slide five do um the graphs you shared with us reflect any one-time dollars on the revenue side i missed whether you mentioned that or not and
155then secondly is there any indication that you the universal meal programs is temporary or will it remain ongoing for us thank you the the revenue there is our is our regular operating revenue uh for our meals it's not including you know kitchen replacement grants and other things that that we may be eligible for with respect to the state's investment in the nutrition program uh when the legislature passed that le in the last session the intent was that it would be a permanent and ongoing program uh in the upcoming in the governor's proposal um there is appropriation for that in the upcoming year so you know every year it will be up for appropriation but the intent was that it would be permanent ongoing thank you ms rawlings thank you we talked about sustainability and um
156and i did ask a lot of questions in advance so i appreciate all your efforts and answering those questions so in those questions um we talked about uh a student utilizing their own utensils and um and plates and that sort of thing how would that work if let's say we saw some of the meals that um that would it's already in a plate so that wouldn't be necessary but then if a student said hey i already have my own utensils or napkins then i wouldn't receive one or how is that how would that work good question i think the plates would be kind of a bit of an outlier you're right just because we have things pre-plated um however we we already have the model of self-selection of utensils so it's it's not that it's
157being issued out automatically the student is able to do it at our elementaries we do tend to give them a little bit more guidance just because we don't want the cross contact of the germs and everything currently with covid um but yes we we would certainly allow the student to provide their own cutlery it's it's really on an offered basis and we understand that we're a k-12 district so there's varying levels of of autonomy uh that is age-appropriate and is that made of is that made aware of are the parents and students made aware of that option you know i've not done any flyers to indicate that to to families but if if that would be helpful for just general awareness i'm happy to put that together ms williams thank you um mr till in
158regards to the universal meal you mentioned being funded annually does this include both breakfast and lunch yes okay and then and then a water or drinks or whatever yes that's okay okay miss rawlings and then as far as the um the staffing um is your intent to potentially increase hours for individuals to meet the needs or hire more folks if they're willing and what do you find as the biggest obstacles in reducing the gap between the staff shortages uh the biggest challenge if i can address that one first um is simply that we have a lot of positions that are that are low our positions you know it's a two and a half three and a half it's really just there to help finalize that meal service and get you know meal service accomplished and
159then do the clean up afterwards so so it's hard to um to find a perfect solution simply because it's a really nuanced field but yes our goal is really to to fill the vacancies that we have as well as finding um ways that we can increase the hours again in the most affected sites we don't just want to assume that there's a blanket solution by increasing hours universally because we've seen some sites are pretty static from prior years and others have seen pretty significant increases ms jones yes mr dill how has the universal meal program impacted um registration for free and reduced lunch for us ah that's a that's a great question and both of us uh grapple with this um you know the the unfortunate side effect of this is that there's less incentive
160uh for families to fill out the uh free and reduced meal application there used to be a benefit you fill it out and you got meals at no charge now everyone gets a no charge meal and we did shift last year to the alternative income verification form um but we have seen our numbers go down uh since the prior year so we've seen a couple of percentage points drop on the number of students who would otherwise qualify now you know that will go into our unduplicated account calculation for the local control funding formula and drive the supplemental grant funding that we were just talking about with the lcap and so you know that could mean a lower entitlement for supplemental grant funding and this is something that's that's definitely on the radar of the administration
161and the legislature um because all of the management groups uh in education have been pointing this out that this is a problem and we need to find another metric for low-income students than the free and reduced application because of the good the good that this program is doing mr pearson you know i i don't know all the menus but i'm going to discuss this question do the menus include ethnic food like hispanic and asian great question there hasn't been a lot of variance from what was set in place i i was hired six months before covet um and then povet of course launched a whole new realm of uh supply chain issues but yes in our procurements next year i actually have a tikka masala sauce on our bid we have tamales on our bed
162um we have a salsa fresca on the rfp for produce so we're hoping to incorporate more um cultural foods i have falafel actually on there as well so hoping that we'll get a good response to our procurement efforts um and that again students will see a wider variety of options great thank you uh mr pearson is that your last question okay all right uh oh oh uh ms williams sorry i just have one question i know we were talking about single single use plastic wear what about um are you doing single use trays or are we doing recycling because i know some programs some uh schools were doing their own isolated so i didn't know what what the status was now and then for the program to be uninterrupted however kovit has presented some challenges
163with just the recapturing of the trays um so i can get an update and send that to you but i don't know where we're at with the recycling of the trays currently okay thank you okay thank you see no further questions uh now is the time for public comment on this agenda item ms garcia please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item and we do not have any callers for this item trustees now is the time for discussion is there any discussion on this item ms rawlings um i did discuss this with dr churchill and i wanted to
164make a request that we schedule a wellness committee wellness subcommittee um in the next few months and that that the board members have the ability to provide input to that agenda uh wait for what purpose could you give us a little bit more to discuss to dive deeper into um some of the the meal planning and um and the nutrition aspect as it relates to our policies nutrition services as it relates to our policies because our policies haven't been really updated um since we've had universal meals we haven't met since we've had universal meals okay dr dr churchill could you um reiterate what ms rawlings is requesting yeah and she did discuss with me in advance um you know we have a standing board subcommittee called the wellness committee and it meets annually so the
165request was could we get that scheduled sometime in the next couple of months and um could the two subcommittee members have an opportunity to work with dr nye who was the the primary point person for organizing those uh to have some input on the agenda and what they talk about at their next meeting so i'm sorry if we do this already why do we need extra consensus it's a regular meeting of the subcommittee am i missing it hasn't been scheduled yet it hasn't been scheduled yet and um uh because we're already starting to prepare for next year my hope was that we get on the calendar before a lot of these decisions already made i i understand that i guess i do we does the board weigh in on calendaring subcommittee meetings that was the
166only thing i didn't understand is it it's an odd we haven't actually had a request to set an uh a subcommittee meeting before a date dr churchill do you need to have consensus from the board in order to uh schedule this meeting which would be typically scheduled annually no strictly speaking we'll go ahead and schedule it anyways i appreciate that trustee rawlings brought it up in advance you know for the purposes of no surprises and and i think um uh you know it was my recommendation that we at least sort of sunshine with the rest of the board so i think we've done that accomplished what we needed to and uh dr and i will work on scheduling right so for clarification's sake we're not asked we're not directing that the subcommittee have any more
167power or authority than before it simply is just to be able to have a meeting correct correct is that correct ms rawlings right there would be no additional power authority um traditionally the meeting is set and then we just show up and so we would be providing some additional input but i think that would be at our discretion anyway okay very good ms williams thank you um i wanted to thank miss awamoto regarding the um appreciation for the presentation it was very thorough and it was um good to see and you work in effort during this time when we're implementing universal meals i want to thank you um i also would like to make a request and it was based on what i was question had questions on is to get a current status of
168the res what this uh we're doing with the recycling trays and single used trays and then the type of trays i just want to make sure we're not using styrofoam and all that so and see about getting uh um see if have thumbs for that okay and is that a request that you had i discussed with doctor i did not i just i i just thought about it and i saw that one article came out city of carlsbad that they're removing styrofoam so i want to um i did not okay dr churchill uh would that be something that would be uh as far as the time cons could you address that um sure you know we have a partnership with the city of carlsbad uh in terms of our overall approach to recycling um i
169do know that as the city of carlsbad is preparing to transition over to a new waste hauler uh which is in fact the same waste hauler that the school district uses um uh we're going to have to have some additional conversation just about you know how all that works so what i would recommend at this point is um allow mr dill and dr nye and i to get back with the city of carlsbad um and uh at some point in the next few months um we can update the board on that meeting and and what we're doing moving forward i don't know mr dill if there's anything you would add to that but i think it's it's this would be in due course that we'd have this meeting and we'd update you ms williams are
170you fine with that yes that's fine and but it also includes the status of what we're currently doing because i know during pre-coven there was programs in place and then i don't know what you know so it's kind of like two parts we'll uh yes that that's that's fine so we'll we'll um i don't think i need thumbs on that this is something that we'd be working on anyways um i just want to temper the expectations that you know it's sometime over the next few months we'll we'll get that lined up yes i appreciate it thank you ms rollins i was just going to say that that was one of the items that i was going to ask to be placed on the agenda for the wellness committee and we've had sustainability discussions at those
171meetings in the past so my hope is is that you and i as committee members would be able to report back to the board on that piece okay very good i see no further hand so we will now for reals move to item 7.5 annual audit report for fiscal year 2020 2021. this is a discussion action item mr dill thank you uh as the board is aware every year we close the books and bring you the unaudited actuals report and following that our auditors get to work and check our work and give us our annual report card on the fiscal services division and uh this year we get an eight plus uh in that we have a clean audit report that is unmodified and has no findings of any material financial consequence so all in
172all a very clean report from a financial perspective so definitely kudos to everyone in the fiscal services department who work every year to make sure that we're following all the rules when it comes to cde regulations the end code and of course generally accepted accounting principles and so this is that uh report which we present to you for acceptance we did meet with the audit subcommittee of trustee jones and trustee rawlings and they met with the auditor and had an opportunity to uh to discuss the audit with the independent auditor and i believe that trustee jones will be uh giving her perspective to the board uh i'm sorry to commit the subcommittee's perspective to the board and so i turn it over to trustee jones thank you mr dill yes uh trustee rawlings and i
173met with mr dill director araceli and um i'm sorry christy white's representative our auditor was his name again i'm sorry uh john i wrote it down and i know you made me blink on his last name uh we met with them on february 9 to review the audit the district once again received and a sterling unmodified opinion for all three sections of the audit for financial position federal dollars and state dollars trustee rawlings also added questions about whether we were meeting our obligations for federal reporting and staff indicated or they indicate that we were kudos to the fiscal services team for resolving the findings from last year's audit and for having only a minor single finding this year related to the timing of the public hearing on the sufficiency of instructional materials which was held
174after the statutory deadline we were advised that there would be no financial impact of that finding and staff has reviewed thoroughly reviewed they said that's their word the audit finding for the fall of 2020 2021 school year and had the mitigating factors have been corrected they said and just so that you're aware specifically the instructional services department had several classified positions in transition that were a contributing factor and the instructional services department was in the middle of planning preparing and implementing fully virtual and hybrid instruction due to the covet 19 pandemic so many of the classified staff were working from a virtual environment which was a contributing factor both of these factors were unique according to staff and have been resolved and that they the team has made adjustments to ensure that these types of
175reports will ensure compliance going forward and that is our report thank you very much miss jones and ms rawlings for serving on that committee and we appreciate the the work and the diligence i'm sure that you took and thank you mr dill trustees do you have any questions now is the time for public comment on this agenda item ms garcia please call for public comment any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item and we do not have any callers for this item may i have a motion to accept the annual audit report for fiscal year 2020 21 as presented so moved williams second pearson
176trustee williams made the motion trustee pearson seconded motion is there any discussion ms garcia please call for a vote trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes that passed unanimously and i should have said congratulations that we had no asb findings that's fabulous uh we now move to item 7.6 measure hh bond program monthly update which is an information discussion item i'll hand it back over to mr dill thank you and this should be a fairly brief update tonight but uh first i would like to introduce the board to our new director of facilities planning and construction management jessica kimbrell and jessica please say hello so that you'll you'll be at the top of their uh screen and they can actually see you if they've got a different
177view hello trustees nice to see you this evening so go ahead go ahead jessica no i was just going to say i'm excited to be a part of this usd and prop hh team looking forward to doing great things in this district ms kimbrell comes to us from the escondido union school district where she's been the director essentially the same position in that district since 2018 for 182 million dollar bond program so uh has is and previously worked in the construction industry and so you know she definitely strikes that balance of school district experience and construction industry experience and next week she'll be graduating from the cash leadership academy um so she started this week but then we're sending it up to sacramento so she can complete that program um but that is a very
178well respected and respected and intensive program on facilities and construction management specifically for schools so really excited to have jessica with us this evening so beyond this i'll give a quick update on the certificates of participation some of the upcoming work that we have with cfd annexation and then the usual project status update so last week we issued just over 25 million dollars in certificates of participation uh those sold at premiums so we were able to bring in some additional funds uh for use in projects which will augment and supplement uh what we're doing uh with measure hh and cover some of our gaps and funding and cover the cost escalation that we've seen since that plan was initially set in 2018 so we have uh almost 28.5 million dollars to supplement you can see
179uh these are the preliminary results uh but this will be reported to you officially next month after the sale closes um we had an all-in true interest cost of uh just under 2.9 percent uh for total debt service of 40.5 million which is a less than a 1.6 to 1 uh payback ratio which is which is really good also the cost of issuance we're just over a percent which is well within the industry average for um for cost of issuance which you generally see from one to three percent so we were on the low end of that uh so thanks to our uh our financial team uh for for um coming in at a very competitive price other capital funding as i mentioned uh the marja acres project uh will soon uh start the annexation
180project uh process into cfd number five so starting next month we will start the three-step process so for the next three board meetings you will have related but different agenda items uh to get us through that annexation process and this is a choice the developer makes to annex into the cfd rather than to pay a developer piece up front so we're accommodating that request and if you have any questions as we go through that over the next few months feel free to reach out to me and then also next month you will see our annual i'm sorry our bi-annual developer fee justification study that sets the stage for us to be able to demonstrate our need to continue to charge developer fees at the state uh rates and that the state allocation board uh is
181poised to increase the developer fees uh soon so that will give us the ability to to increase their rates as well on project status and we continue moving through kelly elementary school um again the npr's looking great the the you actually can start to see the building getting closed in as uh as insulation has gone into the framing so the envelope is starting to come together uh on the multi-purpose room uh at hope we're we're inching even closer to getting our storm water permits i signed some of the final documents uh this actually this monday but then we go through another set of another process and so in the next month or so we should have our uh our stormwater permits and uh we're in the process or on the verge of submitting uh into
182dsa in the city for uh buena vista jefferson and aviara oaks as i've previously reported to you and then uh last week we met with the valley middle school pta uh to give them an update on where we were with design development at valley and that was that meeting went very well so just a few uh lovely photos um you know again these are out of date because now the as of this week we have uh insulation going into that framing so that the building's starting to close up and since we spent so much time talking about nutrition services earlier this evening i thought i would show the interior of the kitchen which now has interior drywall going up and start to really see where that expanded serving area is and that is the update
183for this month thank you very much mr dill and welcome ms kimbrell we're happy to have you very happy to have you join us board members do you have any questions seeing none that now is the time for public comment on this agenda item ms garcia please call for a public comment any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item and we do not have any callers for this item trustee now is the time for discussion i see no no hands raised all right thank you very much we will now move to item 7.7 resolution number 29-212 continuing board of trustees authority to hold virtual
184meetings pursuant to ab361 trustees this is a discussion action item and i'll hold it hand it over to dr churchill all right thank you very much give me just a moment trying to get the slide back awesome thank you um oops went too fast here all right a couple of items to go through this evening as we have done every month for the last number of months uh looking at the next 30 days we'll start with some data trends um pulled these numbers from the county of san diego last week i believe they updated them this evening or seven had a chance to take a look at it uh while we're still in the high transmission uh tier you can see over the last few weeks a steep falling off of case counts here's a
185visual representation of that a peak earlier in the month and things are falling off early in january i'm sorry things are falling off this is the city of carlsbad again numbers are from last week but you can see the same here in the city active cases sharply falling off cdph had a webinar or a presentation on monday i pulled a number of slides from that presentation just to share tonight i thought this was very encouraging uh this is these are statewide numbers but a sharp decrease in cases hospitalizations hospital admissions and test positivity over the last month statewide dr galley also showed this image which i thought was very telling so across the nation there have been school closures this year due to um uh issues related to the pandemic now we're very proud to
186say that here in carlsbad unified we've not had to close any of our schools uh for even one day this school year and uh that goes to show that the mitigation efforts that we have in effect here locally have been working successfully dr galley also showed this slide similar to something that we've showed here locally in the past multiple layers of protection that's contributed to our schools remaining open now as we're moving from pandemic to endemic it is time for cdph to look at modification of at least one of those layers universal masking while keeping the others in place like ventilation and air filtration currency ph requirements as you're well aware uh today in the state of california the universal indoor masking mandate went away uh for vaccinated individuals in most public settings however in
187some settings like k-12 schools that uh indoor mass mandate is still in effect as i mentioned earlier you know we're legally required to enforce the cdph requirements and and we've been given a great deal of information over the course of the year from uh the state about that here's another chart from dr gali's presentation on monday uh indicating that while in many most public indoor settings in california for vaccinated folks masks are no longer required they are required indoors for unvaccinated folks in all health care facilities schools child care long-term care and it's as it's been pointed out in jails and prisons dr galley did share this slide and stated based on our data it's reasonable that we're getting close to a point where state masking requirements can be relaxed he noted that the state
188wants to provide time for schools and parents to adjust the changes in the mass requirement and then noted that there's not one specific metric they're looking at we did want to take the opportunity this evening to reiterate that that in the conversations i've had with dr wooten here in san diego we've been assured that the county will not be more restrictive than the state of california when it comes to masking in schools and it's our intention that our district not be more restrictive than the county of san diego or the state of california we intend to implement the flexibilities immediately allowed by the california department of public health as soon as immediately as soon as they do relax that and while we've been told that there will be a update and press conference on february
18928th we know the situation is fluid and and we're hopeful that we're going to hear something before that as you're aware trustee williamson made a request with your consensus to to present a metric showing the conditions under which we'd recommend returning to in-person meetings you've probably heard that carlsbad city council did vote to go back to in-person council and commission meetings starting in march and so it is staff's recommendation likewise that we return to in-person board meetings beginning in march tonight we also recommend that you approve the resolution so that in this time of covid if a trustee is required to quarantine or isolate due to coven 19 exposure or infection uh that that that trustee would have the ability to meet virtually while the rest of us meet in person so if you approve
190the resolution this evening trust the a trustee would be allowed uh related to covid to participate virtually um it wouldn't change the responsibilities that we have uh for for meeting in person otherwise so here's the the recommendation after board questions and public comment uh we would recommend that you approve resolution 29 21 22 and approve resuming in-person board meetings beginning february 1st i'm sorry march 1st 2022. pause there and see if there are any questions thank you dr churchill are there any questions from my fellow board members ms williams thank you president williamson i just want to um for dr churchill when you s when trying to see what my question is here when the mass mandates change from from cdph does the board need to pass a resolution to implement to make that switch
191or it's going to be automatic no ma'am yeah we we have and will continue to uh follow um the the rules as they're written and uh i i just wanted to be clear with everyone that it's our intention to continue to be no more restrictive than than the state uh when they do make those changes so no board action is needed um you know if if someone has an issue with our approach i'd certainly want to hear it but but absent that we'll move forward uh with all due haste just as soon as we're able to perfect thank you mr pearson dr churchill when we return to uh in-person meetings uh will we be masculine so the current uh order in the state of california is that in non-k-12 indoor public spaces vaccinated individuals are
192not required to wear a mask so unvaccinated individuals then by default are still required um but uh insofar as we're thinking just about ourselves individually if we are vaccinated then we would not be required to wear a mask it would certainly be up to someone's own discretion if they were vaccinated and chose to wear one as well ms rawlings i have two follow-ups but i'll follow up to that one first um does vaccinated mean boosted or just an initial vaccination for mass requirements yeah i'll verify that but my understanding is that fully vaccinated is still defined as the two doses of pfizer or moderna and and they're not looking yet at the booster ms rawlings go ahead with your next question because i see no other questions um as far as a slide what is
193it 14 um when you say that the intention is to implement the um the cdph and you don't find it necessary to have board approval um can you tell me on what basis that is that we don't need to have a meeting and pass a resolution to do that um sure i mean there there are all kinds of uh public health orders ed code government code requirements that um staff would not come to the board of trustees to ask should we follow these rules like but in our mind the default is follow the rules this board has been consistent over the last six months that that the intent is to not be any more restrictive um than what public health allows so i've taken that uh the spirit and intent of the direction the board's
194given us on multiple occasions over the course of the last six months and i've applied that here so even if there's ambiguity you would feel comfortable in moving forward based on the february 28th announcement so um you know it's difficult to respond with certainty not knowing how any public health order is written but if we are to assume that the upcoming public health order for schools mirrors what the current public health order is for other indoor settings i don't think it's ambiguous i think it says pretty clearly who is no longer required to be masked indoors and who is and so i'm hopeful for that same level of clarity from the state regarding schools are there any are ms rollins your hand is still up you have another question yes um when we talk about
195returning to board meetings on march 1st um do you have any additional updates on where we would meet uh what technology would be available all of the procedural stuff as we move forward for march first yep great question so we have learned that both the pac at sage creek high school and the cac at carlsbad high school have student performances booked um on uh in fact all of our upcoming board meetings from now through uh june so so those aren't available to us we do intend to book the pac at sage creek high school for the july through december meetings you know one of the challenges that we face here is our performing arts departments look at the academic year as they're booking the space our board approves the calendar based on calendar year and
196so i don't yet know what dates this board will approve for the 2023 calendar year so all that is to say we've booked out or will be booking out the pac at satric high school for july through december for march april may and june it's my hope to be in one consistent location that may or may not be possible we're looking at our three middle school uh gyms and multi-purpose rooms uh so valley aviar oaks and calavera hills um we're looking at things like the the ventilation and air filtration capacities in each of those spaces we're also looking at the the ease of entrance and egress for staff and for community participants and we're also looking at which of those spaces might be consistently available so um as of this moment right now i hesitate
197to tell you which location we'll be at because we're continuing to work through those things um so more more to come on that but but it looks like it'll be one of our middle school gyms or multi-purpose rooms now in terms of equipment um all of our broadcast equipment is portable when when the board authorized us to purchase new equipment uh last summer we we purchased equipment that could be taken from place to place so the the live broadcast will be uh no problem at all because that equipment is that is movable uh the mic system that the board uses the pa system and speakers for the audience to hear all of that is portable as well i talked with joe hartman briefly about getting some of the big lcd monitors for uh the board
198and the audience use as we project things on the screen um so so that ought to be in place by that time and um we should be good to go on a in-person meeting with a live broadcast and then as the board did uh direct previously uh we'll have the capability for members of the public to call in um using technology so that uh those folks who are unable to or uncomfortable coming to the board meeting to provide public comment could call in um it'll be our first time doing it in the hybrid manner where we're in one place and we're using the live colon feature um certainly we're gonna do some tech run-throughs to make sure everything is up and running um but but we're not totally dialed in yet on uh the exact
199process we'll use for how do you pick who speaks first and who speaks next com when you look at in person and online people ms rollins do you have another question yes that brought up one um and i think this might be for you um with the recommendation are we uh is it one vote or would there be two votes because we have a resolution and then it's also approving resuming in-person meetings the way i have suggested the suggested motion is one motion thank you um i see no further questions now is the time for public comment on this agenda item is garcia please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the
200line press star 9 to indicate you wish to speak on this item and we do not have any callers for this item may i have a motion to approve resolution number 29 2122 continuing board of trustees authority to hold virtual meetings pursuant to ab 361 and to resume meeting in person as of march 1st samuel pearson second jones trustee pearson made the motion trustee jones seconded the motion discussion ms rawlings i had two um items i wanted to bring up for discussion um first um i will be voting no um i actually the reason why is because i just don't believe we have a clear plan we haven't tested the equipment we haven't we actually don't even know what the acoustics will be like at whatever location we choose we don't know what the parking
201is and so um i definitely do want to get back to in-person meetings and i would be very much in favor of that if we had a clearer picture of what we were doing and a better plan so that's why i'm voting i will not be voting in favor i do support the first part i don't support the second part without a clear plan the other this is that i do think as a board prior to um and i don't i don't know if i can make a motion out of motion but um i do believe that we as a board should provide the superintendent with clear direction on um that we do support him making a specific decision based on the announcement on the 28th as a board throughout this the two-year process we
202have been part of that that those decisions and um so i personally would feel more comfortable if we as a board chimed in on that i would very much in favor i'm very much in favor of giving him the authority to do that to make those decisions but um i certainly don't want to um uh to have a question uh once february 28th comes around so that's what i want to bring up in discussion thank you thank you for explaining your your upcoming no vote and ms rawlings if you want to make a board request um during that time at the end of the meeting about uh if you want to hold like have us hold a special meeting or something obviously masks are not on the agenda tonight so we cannot have a discussion
203but if you want to make a request to see if there are three board members who want to perhaps hold a special meeting before february 28th to give the superintendent authority to move forward then uh feel free to make that request um is there any other discussion mr pearson could you clarify the process that we've been using for a request again is this a governance request is that question to me or to ms rawlings it's to you okay the i believe that we had agreed that whenever possible we would make a request let the superintendent know ahead of time that we were going to be making a a request um and we know that there are times that that's not going to be the case um but i think that we had we have agreed
204that that is going to be that that's our standard is that your question thank you uh ms williams so i know we can't make up a discussion about mass but i just want to be clear in case this request that uh trustee rollins is gonna make at the end is if we don't have three thumbs if we don't have a majority what the district's going to do is move forward with what the mandate if if it's the mandate is removed then we're going to move forward with what cdphs are right away is that your question to me or to dr churchill or jessica or is that or you're just saying that that's what i want to be clear and i'm trying to i'm picking my words wisely because i want to make sure if this
205request doesn't go through it's very clear and there's no question that what that's why i asked the question does the board need to pass a resolution and uh superintendent churchill said no so if we do not move forward with a meeting a special meeting we are still moving forward with um with the mandate in terms of the releasing of the mandate dr churchill would you like to address that yeah yeah i just so to be clear uh it's it's our team's approach that as soon as we're provided flexibility we will implement that flexibility i intend to publicly communicate that to families and staff tomorrow so that there's no question in anyone's mind about whether or not we'll be moving forward with with flexibility when it's when it's given i the only thing that would get
206in the way of that right now is if this board directed me to uh to operate or make a decision otherwise ms jones thank you i just want to confirm that we have the authority to call a special meeting should the february 28th decision um go a different direction right now it feels like there's going to be a relaxation of of policies based on what dr golly shared in his press conference but i guess my question is reiterate again what the um capability of the board to call a special meeting uh should things um surprise anyone like do we have a certain amount of time to set another board meeting yeah our board bylaws um indicate that the board president and the superintendent can confer and decide to call a board meeting um we'd obviously
207need a quorum of uh board members to hold that and take any action and for um special meetings i'm sorry for emergency meetings you can post an agenda 24 hours before you meet um generally special meetings would would have a 72 hour required posting requirement but if you are able to determine that you're meeting because of an emergency then 24 hours is sufficient thank you okay um yeah miss williams sorry i just want to make sure that if and i don't know if i can do this because i know we haven't had we haven't approved it or requested the special meeting yet and because once the request goes in we can't have a discussion that's why i'm asking we're almost we're almost beyond where we should be okay this is not i i know i'm
208sorry okay thank you yeah okay miss jones and i just wanted to share with my colleagues that uh i appreciated that dr churchill reiterated staff's com um commitment um [Music] and to their recommendations sorry that we wouldn't be any more restrictive because i think the board has iterated that since we've reopened and that we have been very careful at not being more restrictive so this is it's my intent just so that i can state that to follow the law but not apply additional restrictions so you know in reading the the media today about districts that were still using masks outdoors i know cusd hasn't done that you know we don't have an additional vaccine mandate there's none none of those additional mandates and and restrictions that other districts have applied we followed the law ms
209jones let me interrupt you right now the agenda item is on um whether we're going to continue having authority to hold virtual meetings so we need to be really careful if uh of what is what is on the agenda and what isn't so yes and i was just re using dr churchill's words to reiterate the confirmation of that support thank you um ms rawlings and i i just want to say that that slide 14 is still um we're just discussing slide 14. so that's all as far as it's open for discussion as the broader sense so i just wanted to make sure that i reiterated that part thank you um so now i have to wait let's see where we are so where we are is we're going to uh we've had the discussion about
210uh this agenda item and so um seeing no further hands ms garcia please call for a vote trustee jones yes trustee williams yes trustee rawlings no trustee pearson yes trustee williamson yes that passed uh four to one we now move to item 7.8 revision of board policies for our first reading dr nye thank you president williamson trustees dr churchill we have two board policies that staff is proposing changes to tonight both board policies excuse me have to do with physical education requirements in order to graduate our current board policy requires that all students who do not pass the physical fitness exam remain in pe each year we currently have a number of students who were unable to take the exam due to covert related suspension of the exam last year and they're currently needing academic
211courses in order to graduate the changes proposed in both board policies allow for permanent exemption for students 16 years or older which is consistent with education code 51 241 there's also a provision in that in board policy 6146.1 or in addition i should say where we include the community service requirement that we've had for graduating seniors for as long as i can remember it just wasn't codified anywhere in our board policy so we included that in that board policy with uh the caveat that there would be an exemption for this year due to covet related restrictions around community service and uh i'm happy to answer any questions that you have at this time receives any questions ms williams sorry it was hard to um compare especially i was looking through the the graduate the first
212one the graduate requirements so you're stating and i know there was statements in there that's um that were old basically saying after 2017 and this applies so i saw that those were removed but in terms and i saw the community service but in terms of physical education it states 20 credits or two years but then you're saying there's the the amendment in terms of because of covet if they did not pass the test they still have to require pe is that what you mentioned sorry now that we're changing uh if i can go to the board policy we're changing um the new language is in h under bullets number three it's 3h which would now reach 20 credits or the equivalent of two years of physical education and it read prior to four courses number
213six in the prior board policy four courses in physical education are required all ninth graders except for those students in exempted pursuant to education code five one two one correct for one that's all that information is listed in the other board policy that we're bringing forward tonight so that's updated in that board policy um so that that's one major change and sorry the second major change is to the community service so number four complete the 20 hours community service okay and that may be exempted with class of 2022 due to code i saw that notice that okay so then it does state than all ninth graders but it was just moved because i couldn't find it okay it doesn't mention anything about ninth grade is a code law that students have to be enrolled in
214ninth grade physical education anyways so we we took uh board policies that were written from several other districts and included it there um it does allow for an exemption when students are 16 years or older currently you know if if a student does not pass the california or the physical fitness test we require those students to be enrolled in physical education all four years many districts have aligned to uh you utilize that exemption which is part of egg code which would not require them to be if they're 16 years or older and not require them to pass it as a physical fitness test after the age of 16 but still meet the two-year requirement of physical education okay thank you for that clarification ms jones thank you trustee lamson um dr this is uh in
215response to kovid correct and the second part of that is um which i thought is what you said and so will that revert to four years or this will just be the permanent recommendation of staff moving forward yeah as of right now that's a good question as of right now we we have a number of seniors that need to take academic courses so it's the recommendation as of right now whether or not that becomes a permanent thing i think we need to go back have more conversations with our physical education department the two high school principals to talk whether or not that would become permanent or we'd revert back to previous language thank you ms williams okay all right i see no further questions now is the time for public comment on this agenda item
216ms garcia please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item and we do not have any callers for this item i mean i have a motion to approve board policies 61 42.7 and 46.1 as presented as a first reading so move pearson second jones trustee pearson made the motion trustee jones seconded the motion any discussion um mr pearson i'm raising my hand um i think trustee jones brought something up that uh we i think should be in this conversation and the question i have is uh to dr nye that you know once we get past the senior class and
217once we get past the pandemic and it's you know whatever status it becomes but where the the this becomes not as relevant or irrelevant um will you be coming back to us can we bookmark this will you be coming back to us to adjust the the bp again or the board policy mr pearson just a reminder that we've had questions and so we're on on to the discussion so i'm sorry no that that's okay so let me go discussion is your discussion asking i am hoping that after we get past all this that we come back and review this board policy once we get past the senior class okay so that's a discussion that's something that you're mentioning to your fellow board members okay um are there is there any is there any further discussion
218all right um ms garcia please call for a vote dusty jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes that passed unanimously we now move to part eight which is governance team reports and requests are there any governance team reports ms williams and then miss jones thank you um i just wanted to point out sorry i have my notes um so i want to let the board know and be aware that i will be out of town for a board meeting on may 18th and but then i will be making a request to see about changing the date that's my report all right miss jones actually uh dr churchill uh would you do you want to respond to i so miss williams is that a request that the superintendent tried
219to change the board meeting since you're going to be unavailable yeah okay uh dr churchill could would you respond to that please uh yeah sure i'm happy to look at other dates i think i would um prefer at least right now to make sure that there's board consensus for me to do so um so if if you would do me a favor of showing me via thumbs that you want me to try to move the may 18th date and if there's consensus then yep i'll start working on that is there just one meeting in may yes okay i'm i it looks like there are thumbs for that so if it's possible and and not obviously ms williams if it if we can't find it a date for staff and um and the board then obviously
220it would stay as is okay miss jones uh i just have a quick announcement um i hope you all have heard that our own um [Music] superintendent may be celebrated at our uh san diego county school boards axa honoring our own event on saturday may 7th at sheraton and uh my inside sources for tickets say they're coming online uh soon if not me if not sooner than may 1st then may 1 or march 1st and so i wanted to have you all pencil in your calendars for that since we'll be celebrating our superintendent thank you very much we will now move to and congratulations dr churchill uh are there any requests ms rawlings thank you um and uh it may not be the request you were thinking it would be um i would i would
221like to see consensus from my fellow board members that uh we provide authorization for our superintendent to act immediately from the announcement made that we are anticipating on february 28th from the cdph and to call to only call a board meeting a special board meeting uh in the event there are um ambiguities uh in the um rule length uh thank you for making that request we can't take action [Music] well dr dr churchill um are you comfortable if we try to take a thumbs on that request so yeah i just want to be very clear you know so you know to read back trustee rawlings said to provide authorization you know i think it can be argued i have that authorization but if we were to rephrase that a little bit to um just trusty
222rollins is asking uh her colleagues whether or not they support the notion of of moving forward um immediately following uh an announcement on february 28th is that is that more true to the yes yes yeah so i just want to make sure that you that you have board support to implement immediately whatever that looks like and that the board um only be called in if there's ambiguities that need to be worked out yep that makes sense to me so board support for the superintendent back immediately following the february 28th announcement and only call a special meeting if it's if it's ambiguous that's a tough one who's going to define ambiguous i'd be most comfortable if you just indicate via thumbs that there's support for me to act immediately and i'll come back to you if
223i if i have a problem with the ambiguity then it would be ambiguous wouldn't it i i'm i'm concerned uh related to brown act with the request by saying that we're providing support to an action that's not agendized i while i am totally totally in support of it i i i feel that it's a very close to um it's close to it's too close to a slope that i would not be willing to um to move forward on ms rawlins if you wanted to only have the request be um a the request to actually let me think about this for one second and i would just state that you know uh they're having the i'm sure you with 20 plus years experience with brown act i i'm feeling uncomfortable with action in a request or
224um because the request has to be sunshined in front and public comment and so i just like it would be a request for the next board meeting to come but i think we have tools at our disposal to call an emergency meeting as dr churchill indicated if it's necessary and i just want to i'm i i think that we should consult brown act on this one yeah i'm i think that's it's just too close um uh for me to be comfortable with so ms rawlings i think that we're all on the same page if there's a request that you want to make we can show thumbs but i can tell you if if it's the request that you just made i would not be i would not support i couldn't do a thumbs up for
225thumbs down because i think that it's it's almost like we're we're providing direction to take action and that's not appropriate for um for this part of the meeting because it's it's not agendized so um knowing what if i were to rephrase to that we as a board are directing the superintendent to act immediately and uh based on the february 28th direction from the cdph i i think that that's the same word okay in my mind that that's okay i would draw my request okay all right thank you thank you um are there any other reports or requests dr dr churchill just so that we're all clear would you reiterate one more time just so that there's no ambiguity what's going to happen depending you know what is your course of action going to be february
22628th depending on what occurs there um absent any specific date as soon as the state provides the flexibility we will implement that flexibility uh regarding masks in schools okay and or anything else that they announced that day should should they announce the suspension of all uh onsite over testing we would we would follow suit right like that the point is uh we'll we'll follow suit with whatever is announced okay thank you very much i see no further hands it is 9 34 this meeting is now adjourned our next regular meeting will be on march 9th 2022 at 6 00 pm the location of the meeting will be determined and published at a later date thank you very much all of you good night
