001bye good afternoon hi ray how are you feeling uh like a little kid wants to be in bed i believe we're waiting for two trustees we have a quorum dr churchill we could start and then have the others join us and well no okay i i don't see any attendees so i don't believe there will be any i'm uh i'm sorry trustee williamson i'm i'm communicating with trustee jones right now and i do see that trustee williams logged into the meeting so if you give me one more minute or less than a minute i'll let you know if we should just thank you all right we've got well now you officially have a quorum so you could open the meeting and we'll get everybody closed okay uh good evening it is 503 welcome everyone this

002meeting is called to order tonight in closed session the board is discussing items 2.2 and 2.12 per education code 351 for 5.5 and government code 54954.3 members of the public have the opportunity to provide public comment on these two closed session items now is the time for public comment on closed session items ms garcia i don't believe i see any attendees is that correct i do not see any callers at this time all right uh then we will um [Music] let's see uh the board will now recess to close session good evening it is 601 and the board is reconvening from closed session there is nothing to report from closed session welcome members of the public board members and staff and thank you for attending we'll begin tonight's meeting with the pledge of allegiance led

003by student representative dalen chunko that will be followed by a moment of meditation by trustee williams and the district vision by trustee rawlings my apologies trustee williamson we're going to give student representative chunko just a minute to finish logging in oh okay trustee williamson due to a little tech issue on this end maybe we could proceed with the pledge okay all right um trustee pearson could you lead us in the pledge yes let me uh let me uh get off mute okay there you go right hand over your heart uh begin with me i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible liberty and justice for all thank you ms williams as we celebrated martin luther king jr this

004past monday i would like to take this moment to reflect on a quote from martin luther king jr the time is always right to do what is right thank you and um i'll read from the district business vision about our students our students are engaged self-directed learners they are exposed to different learning environments and pathways students aspire to expand their talents and achieve excellence they are good thinkers communicators and problem solvers ms garcia would you please take the role student representative dalen chunko here um if you guys don't mind me prefer to be just referred to as dale or dalen rose thank you uh trustee jones here trustee williams here trustee rawlings here trustee pearson here trustee williamson here thank you uh we now move to item 4.1 approval and or reorganization of the january

00519 meeting agenda may i have a motion so move jones second pearson trustee jones made the motion trustee pearson second in motion ms garcia please call for a vote trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes that passed unanimously we now move to part five this is a discussion item uh 5.1 census 2020 due to time constraints of our demographer we've organized our agenda this evening to hear his presentation as close to 6 pm as possible trustees thank you for your willingness to do things a little bit differently again this evening this is an information discussion item dr churchill uh thank you very much i'm going to give you a couple of brief overview slides there we go so for the site on this evening um after my

006brief overview we'll hand it over to our demographers to walk through some information uh that'll be followed by a public hearing in which we take public comment and then we'll move on to board discussion and direction in terms of background as you're aware cooperative strategies was retained by our district to do a demographic review of the 2020 census data and to determine whether population changes reflected in that data would result in required changes to our trustee area boundaries so in december at our december 15th meeting cooperative strategies presented their analysis and timeline for updating our maps there was time for public comment then and the board did direct the team to develop several draft maps um on january 9th we posted those maps to the website and there was a online form for public feedback

007those are the maps that will be reviewed this evening i just want to do a quick reminder here on the the things that are being considered as we update our maps to conform with the the requirements um we we did have josh chisholm um with us on december 15th he indicated that generally the items listed there on the screen are taking into consideration um it's required that each area contain nearly equal number of inhabitants and it's required that we draw the maps to comply with the federal voting rights act and then things like being compact and contiguous respecting respecting communities of interest following man-made natural geographic features and respecting incumbency all of those are to the degree possible uh and then finally any other local considerations uh the board did give direction at the january

008i'm sorry december 15th meeting to do a couple of things one start with the existing map respect the incumbency and then make tweaks from there which really is in keeping with the the spirit of the um the the federal and state rules to create is one of the options a map that puts the oceanside plaza area and the quarry crete community together as a community of interest and then to maintain our priority of making sure each school's attendance boundaries are in more than one trustee area so that each elementary middle school is represented by more than one trustee um oh i'm sorry and i was going to make one more note it's important to note that the city of carlsbad is going through the same process right now our maps cannot line up with theirs

009they have four city council districts we have five trustee areas so right there there's an incompatibility the the geography of the city of carlsbad does not line up exactly with the geography of the carlsbad unified school district boundaries as well so just just a quick note um in terms of public feedback as i as i noted uh the demographers presented their findings a month ago there was an opportunity for public feedback at that time draft maps went up online on january 9th with a link tonight we're presenting the maps again public hearing public comment opportunity uh we'll bring back the final map or maps at the february 16th meeting again there's there's time for public comment there um we'll keep the online forum open until that meeting and uh you can always email us directly

010as well with feedback uh so as of today we had 22 respondents via the online form uh and uh one emailed comment uh in fact uh that probably uh i put the slide together at noon time maybe there are four or five email comments um by the end of the day today all right so i'm gonna hand it over josh chisholm i think i saw josh on the call from cooperative strategies following their presentation the board can ask questions we'll have a public hearing to accept public comment and then board discussion and direction uh followed by our february 16th meeting where we hope to have more approval and mr chisholm i will uh make sure that you can share your screen it's all you i believe i can thank you let's see all right good

011evening and uh thank you for having me board and community my name is josh chisholm with cooperative strategies and uh as dr churchill mentioned we were here back in december to provide evaluation and discuss some of the trustee areas that you currently have and how we can make adjustments and so tonight we're here to review three scenarios that we've put together that bring the district back into compliance and we're also here to get feedback from the public and the board on the scenarios that we put together after this and if we if we have any additional changes to the scenarios that we've put together we'll make those changes in the next couple weeks we'll be back in mid-february to take a look at those and look for adoption of one of the scenarios after that

012we will work with the county registrar voters to get the to get the needs uh that they require for the uh for the ballots to have the right folks to have the right folks getting the right trustee areas on the ballots with the right trustees who are running for those areas this requirement is to be met by the end of february february 28th so if we can't reach adoption here on the 16th we have we're down to the wire but we do have a little time if we can't make it on the 16th all right and so uh just as a reminder these are your current trustee areas and we'll dive into these a little bit deeper uh in each scenario but you'll see here then scenario one uh that we drew these with several

013things in consideration as dr churchill mentioned when we were here last there was some specific feedback on where we wanted to start now we wanted to start with the green map we wanted to consider a few of the communities in this in these adjustments try to keep certain communities together make sure that the elementary schools middle schools were represented in all the different trustee areas and so in this scenario you'll see that certainly balancing out the populations is something that we must do in all the scenarios and reducing that variance down below 10 percent if you remember we were at 36.4 percent overall with the current trustee areas and that was the impetus for having to make the adjustments as i mentioned ensuring school attendance boundaries are are in more than one trustee area um

014respecting incumbency is is something that we we did with scenario one all the trustees are still in their own area and also we wanted to take a look at the hispanic latino see that percentages uh to at least trying to keep these the same in and if not increase them and so in this this scenario here oceanside and corey creek communities are not in the same trusty area and that i believe was one of the requests but you'll see in some of the other scenarios that they are and so down here at the bottom you'll notice is the total population for the 2020 census and that was the current trustee areas and then here in scenario one we're down to 2.5 percent so here's the map of the scenario you'll notice that the dark blue

015lines are the current trusty areas and then the colors in the background are where the new trusty areas would be if this map were selected and so you'll notice where the colors are drawn outside the lines are are areas where the trusty areas have expanded or move have expanded or shrunk in order to balance out these populations and so um in this area here uh where where it was previously trustee area one uh trustee three and two have moved into these areas uh to balance these areas out you'll notice down here in the southern portion of trusty area 3 it's it's moved south into trustee area 4. trusty area 4 has moved east into area 5. and then also here on the northern side so a lot of the movement has has really kind of

016happened here in the center and then also in these left uh north northwest portions as well so as i mentioned uh 2.5 percent is the total variance for scenario one you can see that that's driven by adjusting area one which is just slightly higher than the ideal trust area size and the with being the most populated trustee area and then trustee area 5 being the least populated area which is slightly below the target population that we're looking for with the adjustments that were made just as a reminder as you walk across the table here you'll notice that the hispanic latino community the representation within each trustee area is 23.1 percent from a total population and 19.3 percent from a citizen voting age population so just to permit refamiliarize uh the board in the audience on

017how to interpret this data okay so in scenario two we drew a second scenario again we our primary goal is to balance out the populations get the variance below ten percent um in this scenario our attempt was to keep trusty area three more compact and contiguous than in scenario one where it was more stretched out again the school attendance boundaries are all represented in more than one trustee area i know it was a goal and a priority for the board respecting incumbency in this scenario there are two trustees in area two and zero in area five and so although respect respecting incumbency is not the only consideration it is a consideration in this process uh keeping the oceanside and quarry creek communities in the same trustee area was utilized here in scenario two and also

018the hispanic latinos see that percentages were roughly the same here in this scenario so again you'll notice in the bottom right hand corner this scenario the variances is 3.8 percent and here you can see the map itself excuse me and you'll notice that there are some changes here trustee area 3 is certainly more compact less stretched out it does expand up in the northeast corner here trustee area 2 also expands to the northeast to balance out that population here trust the area of four again moves northwest into trustee area two or i'm sorry three and then also uh here in the southern portion there are slight changes but but the biggest change would be trust the area five and how it expands over to the west okay so here's the data for scenario two again

019the variance is three point eight percent and you'll notice that that's driven by the least populated area which is area 1 and the most populated area which is area 5. all three of these scenarios are very very low variances and so the variance is certainly within the threshold that we need to be in uh to get back into compliance all right and then the last scenario that we put together on on this powerpoint here we also did look at several different we explored several different scenarios as well beyond these three uh that were not able to keep into compliance but this here is the third scenario that was that we were able to get back into compliance by making the adjustments uh uh in this scenario all the trustees are the same uh are in

020their own area again the school attendance boundaries was a priority that we kept push inside corey creek communities are in the same area again in this and also the hispanic latino cbap percentages are are roughly the same uh here in scenario 3 as well this one's slightly higher at 4.6 percent uh but again very comfortably below that ten percent threshold that we're looking at uh and here you can see how the uh map is different in scenario three uh i would say similar to scenario two uh to some extent you can see uh the trustee area two moving up into the northeast again and then also trustee area five down here in the south slightly slightly larger movement here and trust the area 4 to the north but similar changes here to the northwest corner

021of the district so here's the data again the variance is four point six percent driven by trustee area one in trustee area three uh you can see the uh the demographics and how they play out amongst the district but the uh given the hispanic latino community makes up the largest minority in the district that's one that we we're given a priority from the board to to ensure that we're maintaining those hispanic latino percentages and see that percentage of citizen voting age population percentage across the trustee areas this slide here shows a comparison of all three scenarios so you don't have to flip back and forth you can see the variances here are all acceptable from our perspective any of these maps would be acceptable and with these variances and how the maps are drawn and

022tonight we look for feedback from the board in the community if there are requests uh from an adjustment standpoint not none of these three scenarios are the be all end-all we can go back to the drawing board and make adjustments in different areas if for example these adjustments that we made have separated a community that shouldn't have been or that that the board of the community would prefer weren't separated and so that's really the intent tonight is to get some feedback on these scenarios and um and then we'll go back to the drawing board if we need to with that oh i've i wanted to mention that the orange map was something that was requested at the last meeting as well and so we did throw in this analysis here the orange map uh if

023if we looked at the 2020 census using just the boundaries that the orange map was drawn using we would be at 29.8 percent variance which is slightly lower than the green map was that was adopted but we certainly would need to make adjustments had the board adopted the orange map during the transition we would be in the same position that we're in today adjustments would need to be made to get back into compliance the data has been provided as well here with the orange map and with that i'll i'll turn it back over to dr churchill thank you sir and i'll actually hand it over to trustee williamson thank you thank you mr chisholm trustees do you have any questions for mr chisholm um ms rawlings thank you um mr system how many attempts did

024you make um to meet all of the considerations that have been listed in developing these scenarios so uh we put together officially we put together seven uh official attempts but uh as the analyst is walking through the scenarios um it's not that they don't immediately come to a solution and so it takes it's a process to find the census blocks that have the right amount of people that are connected to the right trustee area but the official answer is seven uh scenarios were put together to narrow down to these three are there any additional questions as long as your hand is still up is that intentional yes i have i have okay a few more questions actually i'm a follow-up to that when you say that there were seven attempts are you saying there were

025seven attempts to come up with these particular three and then we've had some other questions on these three correct so uh we we received quite a bit of feedback uh between the december meeting and today and so there were several requests um i don't have the example on top of my head but let's just say one of the requests was hey would you try putting this area into trustee area 4 and see how it shakes out but the variances came back well over one of the variances was pushing 100 over and so the scenarios that we presented are the scenarios that were in compliance the other requests that we received we did put together uh an analysis but the they were far from being in compliance but my question is is that the the three

026that are the three scenarios that were presented how many attempts did you make in order to try to achieve all the considerations in the three that were originally presented prior to adjustments uh i'm sorry miss rawlings i'm not understanding the question so we there we had um all those considerations as far as um you know balancing the population incumbency landmarks you know all of those things and the quarry creek and that sort of thing how many attempts were made based on those considerations to come up with these three scenarios i i don't know that i have the answer you're maybe looking for but we were able to create these three scenarios and the scenarios were not able to necessarily accommodate all of the requests the the different combinations let's call it four or five priorities

027that the board had at the last meeting i don't know how many iterations we went through to come up with these scenarios but this is the this was the result uh these three scenarios were the scenarios that we could come up with that accommodated those requests as best we could are there any additional questions um i have a question is miss jones yes and uh mr mr chisholm i guess the the of the seven uh priorities that that were laid out there are a few obviously that are a higher priority so complying with federal voting right acts which is required and then making sure that the each of the areas has the equal number of inhabitants how was priority given to the remaining five is it based on how i guess what would work based

028on the first two is that what drove kind of the selection so correct the federal voting rights act and the california voting rights act the elections election code those those are requirements we have no way around those and then so those are our highest priority um having school school attendance boundaries in more than one trustee area from what i understood was a high priority of the board so that was that was at the top of our list after what is required by the law after that the hispanic latino sivaps were important uh as i understood it the oceanside and corey creek communities the preference was to keep those together but if we had to make a sacrifice that was a sacrifice that would be made first and and that's what happened with scenario one we

029were able to obtain all of the other requirements but we weren't able to keep those two communities together and so scenario one was the result thank you that's helpful mr rawlings do you have more questions i do i have two more okay um when you're talking about the priorities um what process did you go through or how um how did you determine that roads and landmarks were less important than um than corey creek and um the plaza area right so as we walk through the process you know the first thing we would do is look at let's just say for attendance boundaries if trustee area 5 needed to grow and we knew that we only had one school in the area right now in this area and trustee 2 needed to grow and trust e5

030needed to shrink growing trustee area 2 into area five where those schools are at would be the first step we need to get two schools uh we need to get school attendance boundaries into trustee area too because it's shrunk on the on the west side so we need to grow it on the east side and cover those school attendance boundaries that would be the first step and if it's out of compliance with the variance then we have to find areas to shave population down in order to get back into compliance and keep the school attendance boundaries within this trustee area once we accomplish that then we would look at the quarry creek in the oceanside communities and say okay here are these communities can we make adjustments to the map now that gets these communities

031together but doesn't sacrifice schools in each trustee area rawlings go ahead and ask your last question thank you and this one's for dr churchill um dr churchill um in some of our conversations as we've been leading up to this meeting these meetings um um i'm curious about scenario two is scenario two too much different from our current maps um and would it need to be tossed out based on the information that we've received um over the last week um i i think that's a fair assessment if we're going to stay true to the intent which is to take the maps that were approved in 2017 and and make as few changes as possible to come into compliance it seems to me that that trustee area 2 is is such a remarkably different map that that

032there's very little in common with what you all approved in 2017. and just as a follow-up so that would go against the advice that we've received and that has gone out to responses to the public is that accurate that that is correct we you know had legal counsel weigh in on um and and they confirmed that the intent ought to be to make as few changes as possible um and you know i have been doing my best to respond to community members as they've sent uh feedback my way um i've responded on behalf of the board for our protocol and um in a number of instances uh after i explained some of those items um i got favorable responses back saying thank you i understand that that was very helpful you are there any additional

033questions uh ms williams i mean and just for scenario three is there i know there's no requirements but is there any rules because it seems like the trusty area five just keeps growing in terms of there's no it doesn't look continuous it just looks like it's just growing south and and west is there any guidance in terms of that or just try to stay away from those type of scenarios so com compact and contiguous would be the consideration that you would be referring to and it's not a requirement but we want to keep the trusty areas as compact and contiguous as we can now with that said most districts in the in our state do have rural areas and you'll generally see a trustee area that is much larger than the rest and that tends

034to have a shape that covers a lot of rural area but doesn't necessarily have the population and so it doesn't it doesn't mean if if for example in this northeast corner that there aren't many people if any that live in this area it could be any color and you know let's just say for example we wanted to make this whole area blue that's that's acceptable as long as the board and the community are in agreement if it doesn't throw off the population variants and that would make this map more compact that would make it a cleaner map it's not a requirement but it's an option any further questions okay thank you now is the time for public comment on this id on this agenda item please note that public comment on non-agenda items which usually

035happens at the beginning of our meeting will be taken later in the meeting ms garcia please call for public comment if any member of the public wishes to provide public comment on agenda item 5.1 census 2020 and trustee area redistricting now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item and we do not have any callers that have indicated they'd like to speak to this item thank you i trustees this is the time for discussion i'm going to ask each of you to indicate which map you support feel free to provide a brief explanation if you'd like if you haven't decided which map you support you can pass if after everyone has spoken one of the maps has the support

036of at least three board members we will then focus on that map we'll discuss any recommended tweaks checking in with the demographer for any input he has and if there are three board members in support we will direct the demographer to make that change if if no one map has the support of three trustees you will all be asked to share your thoughts on your map of choice and concerns you may have about the other maps the discussion will continue until a map has the support of at least three board members at which time specific changes to that map will be considered so would someone like to begin with sharing which map they support miss jones thank you president williams oh williamson first i want to say thank you to the members of the public

037for providing comments tonight uh or today and in the last week and by email i've appreciated your feedback and and your willingness to seek clarification for your comments so thank you for your participation in that part of the process i did want to take a moment to clarify that having more than one trustee representing the elementary schools was of interest when the green map was created um in 2017 and and i just thought it'd be worthwhile to revisit um the rationale quickly at least from my perspective when we had this discussion um and and a lot of it was that we are a five-member board and i think in in the comments some of the comments that we received members of the public were like why do i have to deal with more than one

038trustee well i think a lot of people forget that as a five-member board it takes at least three members of this board to vote to move something forward and so in an effort to make sure that trustees wouldn't just focus on one area or one elementary school we thought that having trustees more than one trustee represent a school would ensure that you know the community was being heard and listened to certainly by all five of us because we are a unified district but that those who were voting for those trustees would be represented by more than one and so i just thought that would be worthwhile to bring that forward so tonight i will be supporting trustee map one because i believe it follows the seven considerations that the board requested in 2017 and also

039makes minimal tweaks to those initial maps had major census changes occurred i would have considered a different choice however i feel map one addresses all of the issues that we've required and or that were required and that we requested there may be is one small tweak along el camino towards calavera hills area that i'd like to have a conversation about as we go forward but that's where i rest now so thank you thank you mr pearson i too want to thank uh thank everybody who from the community is as well as uh demographers who uh had to line up our seven priorities as well as making sure that the federal and state laws were abided by to do this and i appreciate my colleagues you know i saw some of the additional maps some of

040the rationale behind it and take that all in and so in making my decision i took that all in and said what's going to be the less least disruptive what's going to keep the seven seven factors that we had all agreed on back in 2017 to keep our community as at large as possible our trustees at large as much as possible in this environment so i'll be supporting map one as well thank you mr pearson um either ms williams or ms rawlings would you like to okay yes ms williams thank you thank you um so i would like to also thank josh chisholm and the cooperative strategies and the community feedback that was helpful um i will be voting for map one with some minor adjustments um but i wanted to think that that would

041that map took into consideration the majority of the issues that we had and and that we brought up thank you ms rawlings are you ready um well we have three so i guess uh it's not not sure it matters as much um i was i went back and forth with some of these maps um i i do have concer i had considerable concern about um two um just because uh it seemed like many members of the public and i did like the condensity of two um but it does go against kind of what we were given so i felt that that was a bit of a uh we were spinning our wheels on that one um to be honest with you um so um i have looked at one and i do have some some

042um suggestions to one that have been that have gone through the demographer um so uh i guess it would be map one uh c would be that would be the map i would support uh so it'd be uh one with adjustments okay thank you and i too for the for the reasons that people have already expressed i would be supporting map number one so having said that um there are uh each of almost each of you have mentioned that maybe there are some uh adjustments that that you would like to uh consider uh as i and and i'll start on this one as i looked at the map there was a very obvious one to me the at the original uh the at towards the top of the map this the street trieste moved over

043from trustee area two to i believe to trustee area one and it was just a little just a tiny bit of of the street i think it was from chestnut down to tamrac they're currently in trusty area too anyway so things like that i know i wasn't even positive i thought maybe it was even that it was colored incorrectly because it seemed a little bit interesting so if you could put up mr chisholm could you show map one a r i can't uh you can't i can let me pull that up for you sorry okay so i know that uh trustee rawlings would like us to look at one c if we could if you don't mind if we could start with this one and then we could then we'll uh go to that one

044um so um and just for clarification this is um based on trustee feedback that was provided to mr chisholm separately yes thank you yes so uh is it is there a way of making this larger i can zoom in is there an area where you think and trust the area one yes right about where you are where you are so if you go to el camino real and um now go travel south it was about um let's see oh yeah i'm sorry i keep going further south so it's around in this area that the right to the road to the extreme to the right of where the cursor is is trieste and that area was actually originally in i think trustee area three or four one two three and trustee area three with in map

045one and so i had asked if that be could be put you can see the road trio so it's back basically where it is where it's started in trustee area two i believe that also at the corner of college and el camino yes right it was right in there thank you this would be trusty area uh three or four i i i support the way that it is now oh okay okay i'm sorry it was in it was in the original now trustees maybe i should ask you this should we be starting with the original map should we be working on that as we're making the treat the tweaks rather than i know all of you have seen this map one one a r one a r but maybe for the clarity um if you

046could if you would i i guess i'll just ask the question should we start with the original map or with this one that has already been tweaked if you want the original map please show your thumbs in my view the original map is already drawn out with the blue lines when i say original i mean that not the one from 2017 i mean the one from the regular map scenario proposed scenario one post proposed proposed scenario one that was posted on the website should we start with that one and then just describe the tweaks would that be cleaner do you think yes all right we will let's go back to that one i'm sorry let's let's go back to that one and then so here's scenario one and this is the area that you were

047referring to three had moved so i my proposal is that that area be put into trusty area three which is it i mean in trusty area two the green the green the green yes yeah and that's that's the one tweak i wanted to make as well yes so i'm going to ask for the i believe the way to do this is to show thumbs one recommendation at a time so if you could show thumbs if you support moving that i see just a clarifying question yes it would help me to make my decision thumbs or thumbs down or neutral if i had some rationale y to move that by either one of you uh trustees the the reason thank you the reason for it is it currently is in trustee area two which is the

048green area el camino real is a major thoroughfare and the it's it cuts the road it cuts that the um trusty area three just a little sliver of it off on the other side of a major thoroughfare and it was easy to find offsetting population in another area and they're currently in trustee area 2. so those those were the reasons that it seemed a little bit of an arbitrary to to capture basically half of a road when that can be done very easily on the um other side of the el camino real without crossing um a major road without doing that and i echo those sentiments that's it was el camino really for me jesse pearson that it that it cut it just bled just tiny little bit across and that's a a neighborhood right

049there so anyway yes mr pearson does that answer your question it does but i the second part of that was for mr chisholm how that impacts the variance okay and so i i believe where we're headed is uh the variance for scenario for a and i don't think it was so we're at 2.7 in 4a which there were there were a few different changes between here and there so i don't i have the overall impact between the two but not just that small sliver you know in scenario one we were at 2.5 percent scenario two we're at 2.7 percent so very very minimal impact between the two dr churchill thanks yeah i was just going to interject you know it might make sense right now to continue through the exercise of identifying those areas that

050we might want to make tweaks i i think at the end josh mr chisholm will have to kind of take a holistic look at it you know every change in one spot will have a offsetting change somewhere else and and so if we can hone in on maybe the different areas that trustees have interest in moving i i think we could probably then give mr chisholm um some homework to to take those areas that he that we indicate we have interest in moving and and seeing if it's all possible all right trustees are ms rawlings did you have a comment that was what i was going to suggest as well okay all right um trustees with thumbs would you indicate if you support uh trying to go work through all the changes at once i'm

051fine with that okay great all right so we have the first one and dr churchill you're keeping making copious notes correct all right okay um so what uh so ms jones that covered the your the change you want to make i believe ms williams you also said that you had something or was that yours also i had that um that comment as well as there's another version and the explorer exploration draft c that's part of one and the the issue i have and and and maybe it's just me there's one street that has three trustees that on the north um it it's the where the yellow and the red it's on the it's by district one in the current district one where there's right there that one street is three trustees if if there's a

052way that we can just have more of a cleaner cut and that there's an exploration draft c that cleans it up there's another version that cleans that area up um so in what is your concern about having the three boundaries meet it seems like within three four blocks it's you literally don't even know which you're between within four blocks there's four trustees i don't know if that's if there's a way to clean it up so it's just like a clear straight where one truss it's it's either green or yellow and then there's a cleaner mark on the red so it's more south as in using tamarack as the line um and that i know that that there's another version draft c that cleans this up a little bit okay then let's look at let's finish

053looking at this one and then maybe once we go to okay all right and ms rawlings did you have any comments on this one well um similar um but there's also down um off of tamarack um where you have um that's area one and then you have area three um where again the lines don't have rhyme or reason they don't follow like you were saying along a a major thoroughfare or at least a major street so in my view you you stop area one at tamarac and you fill in the area one and you fill in area three up to tamarack at the at the five and carlsbad boulevard as well as where trustee williams was talking about um the suggestion is is that you follow tamarack pet over magnolia and then up chestnut i

054believe that is what that street is and so you kind of take area three area three goes up to tamarack and then you and then uh is follows along el camino real again to clean it up and then there's another one i have as well that follows tamarack up in area 5. uh so ms rollins the population that would be lost to trustee area 3 where would you be recommending that that be added it's gained it's gained at uh carlsbad boulevard and tamarac that right there if you cut it off at tamarack you've got that whole population that would be there and that it would be made up and in the and in running this scenario including other areas that again just kind of following major roads um that we're still within our 10 10

055variants okay so the popul the lines for trusty area one the uh south west would be the beach and tamarack and then it would follow tamarack to win to where ms rawlings to um el camino real or no i'm sorry one would not follow there i'm sorry uh one would go up to i believe that's magnolia and then cut over at valley i believe okay again we're looking at like uh it's um uh valley magnolia and monroe as far as uh and then actually area two would move closer into down to monroe and then area 2 would lose a little bit up in caliber hills to make up for that so again if you go up tamarack up into caliver hills and you follow tamarack around the big circle and that goes into area five

056that's where you make up for the for the um and again those instead of the lines being cut just randomly they're actually they run along a actual you know a relatively major street within carlsbad okay all right are there any more comments mr pearson uh president williamson is it appropriate to ask questions of uh another trustee on their comment i believe so yes we're at discussion yes for trustee rawlings that those changes that you propose is that because of geography or is that why you're you're making those proposals i'm not sure what your rationale was yes it's instead of breaking up neighborhoods to where you you know you look across the street and that's a different trustee area and you look down the street and that's a different trusty area you're able to run the

057trustee areas along what would be again semi-major or major thoroughfares um in order to break up neighborhoods and then people could have um uh there's a little bit more simplicity to the map um some people have a real a real strong idea of where they land in their trusty area thank you and so and again making it up in population on one end and then um you know finding another place to where you're making it up so we don't run into the variance problems ms jones um trustee williams does this line up with your recommendation from [Music] as well i mean the tamarack i know the tamarack cut was similar but is the east west yeah i i see that where if we use tamarack as the major road where jefferson's at if we use

058that then that will suffice using where that would take away the red off that one area where carlsbad high magnolia and then the green area can actually cover that so it's more continuous there's versus if it feels very chopped up up there like we're not even using a major thoroughfare okay and i guess i have a follow-up for mr chisholm these recommendations what was the variance for for this uh trustee williams request or i guess trustee rawlings request the request that she's making right now i wouldn't know until we go into this offer and make the changes oh i see okay i'm just to be clear the recommendations are within the exploration c okay then i perhaps what we can do ms jones did you have something else your hand is up no i apologize

059okay okay um uh as far as this map the minimal changes that i would recommend are simply the putting the um trieste back into trusty area two and i believe that that keeps in with the spirit of having making minimal changes and which also keeps in the spirit that the fewest number of people are going to be in essence deprived of being able to vote for six years that there you know there is a population that i'm sure all of you have thought about this that voted for a trustees in and depending on where we make changes they will not be able to vote for a trustee again until 2024 so they will go for six years without voting the more changes we make the more trust the more citizens are probably going to fall

060under that so the my my understanding is that probably one of the reasons that the recommendation was to leave the lines as close to as as they were as possible is to prevent that scenario and so as we're if you could all just keep that in mind that there are a lot of things that i would like to straighten and clean up but as i keep in mind what is the impact on the citizens of that um i i would pref i would prefer that we keep as many lines as possible the way they are just doing what we need to do in order to balance populations so having said that mr pearson and then let's look at the map c yes very quickly i want to support president williamson on those comments about people

061voting for certain trustees and expecting that trustee to still be within their voting area okay all right so if um does it i guess i'll ask do three trustees want to go ahead and look at tr at map c um please do show your with your thumbs if you do want to look at map c i see ms rawlings okay yes i see three so if we could go to map c i think this is map 1c is this correct is this the map you're looking for ms rawlings is this what you're looking for yes yes and actually i will say that this is a very helpful one because it has the populations written on it okay so it would be helpful if we could summarize the changes between the original map scenario one that

062we were presented with and this map c okay uh in this scenario uh as ms rawlings mentioned uh we we did move trusty area three to follow tamarack avenue here i'm almost over to the beach there's a little sliver down here that is still there but in essence all of the population here was captured in uh trusty area three and then you'll notice here where the schools where were that trustee area 2 was moved over to fill in this entire area that trustee area 3 had included above north of tamarack avenue and are there any other changes to the map between one and c other than that none on the south end there were some in the north too oh i haven't i did not put a comparison slide together to show these here on

063the southern end i can get rid of the other three here and bounce back and forth yeah so up here on the northeast side of trusty area 2 northeast of hope elementary this was this boundary here you can see also changed that trusty area 5 has moved to the west across what the existing boundary was and as ms rawlings mentioned if i can zoom in here on this area you'll notice on this map it's a little bit busy but we drew we overlaid this map with the census blocks that the census bureau provides and then the numbers within them are the total population and so the boundary lines that are drawn follow these census block lines and capture the folks that live within these census blocks so ms rawlings if you could point out what

064the difference is in this in the northern part um right there where um uh tamarack instead of having the the boundary uh just um not even along a street the boundary literally divides uh individuals homes they the actual boundary would go along tamarack and uh that how tamrac circles around and goes in front of hope elementary being now included in area five um instead of um instead of like i say just a random line for the boundary and then the other the last change is actually uh further south um again where you literally the boundary it looks like it's it's uh dividing someone's home um it just follows along um aviara so it goes into a chunk of four and also to address uh some of your concerns uh trustee williamson as far as election

065goes the cycle would be very similar except for a very small section between area one and three but uh as far as the elections and this election cycle slightly um in that section uh and what is it and then there's in the south there's one more small section that um was there as well i don't know if you can move the map to the south we're gonna mute myself this is all the way to the south and then i can show uh scenario one as well and then you can see like aviara parkway that little blip reduces the population slightly in four and again follows a at least a a street rather than just the line being drawn where there's really no um significance to where the line is so those are the small changes

066and what is the variance with this map mr chisholm uh variance is 8.3 on this scenario uh 8.3 correct and we can go up to 10 but the others were in the twos right the other three were 2.5 3.8 and 4.6 so uh this one is is certainly higher but it's it's within the variance um 8.3 is certainly an acceptable variance you know i've seen districts uh when they get into the nine plus um i've seen advice from their legal counsel say you're pushing the limits here but i've never seen that below nine percent okay are there any comments um on this map c ms williams does this so map c is the is uh it solves uh your concerns yes i have a i have a question about this for presentation's sake i guess

067um procedurally dr churchill um could we have um josh's or mr chisholm's team create the similar map as the conceptual scenario one and then have public comment on those two leading up to our february meeting because i i would like to have more public input on these changes i i i like that the cleaner along you know cleaner lines along the major thoroughfares i think that makes a lot of sense but i just want to i want to hear public input on on that as well thank you for the for the process question yes um i would hope that following this meeting uh we'll we'll get some direction for some of these changes we can then um pull down the map 2 and map 3 we can leave map 1 up and then we can

068put you know map 1a map 1b if necessary with some of these changes and keep the feedback form open invite comment again through the same channels and uh yep and then then compile all that for you at the february meeting thank you much of this what i'm seeing on map c makes sense my concern is i can't see the lines of the current um how it is currently because it unlike the other scenarios the existing lines i don't believe are there so i'm not able to see the changes it is important to me to really identify how many of the voters are going to go with for six years without being able to vote that to me is a is a very high priority to minimize that and uh it it might not be significantly

069different between well if we let's just start calling them maps one and two that said okay with everyone so these are all map one and then the first one was the one ar and then the map c is map2 so we can so if we map one we know makes the the fewest number of changes but that doesn't necessarily mean that fewer voters are going to be deprived of being able to vote for those those extra two years so if we could if we could see exactly where the changes are we'll have a better idea so uh unless somebody has some comments i would like to have you show thumbs that you would like to direct staff to uh or to mr chisholm to have maps one and maps two uh that would show the

070original that the current um borders boundaries as well as obviously the proposed like this with in the color and that we would somehow identify which areas the voters most recently voted in 2018 and that they would not be vote able to vote in 2024. well actually i should ask is that of interest to other board members to have that information i see one thumb so if it if that's i'll ask show your thumb if you or would like to know with the changes on both maps one and maps two basically how many voters would it would impact their ability to vote at least once every four years is if that's of interest to you i just see um two thumbs that are interested in that okay then we then we will not ask for that

071uh would you want to see for map two where the williamson you had three first one who i saw mr pearson and myself oh ms williams oh okay i thank you for letting me know okay so so dr churchill is that something that that we could conceivably i'm not asking necessarily for the number but if we could highlight the areas so so yes as i conceptualize your your question and mr chisholm if you go back to um scenario one yeah your other tab there so so we'll mock up um so we'll have this version and we'll have um uh the what we are calling exploration c also mocked up in this version so you can see the blue lines you can see the overlay of the colors i think that shouldn't be too hard for

072mr chisholm to pull together and then once we get those i'll go ahead and just do a quick analysis of in each of those versions which of the um which areas would have been voting for someone in 2022 and are now moved to a 2024 election that shouldn't be too hard for me to just do a quick quick uh you know i can circle them on the map and show you what what areas are impacted okay thank you i believe that three board members uh have directed that so thank you are there any uh ms rawlings yes um i had two things um on that note is it possible to also carve out the new developments because they wouldn't have had the opportunity to to vote prior to their home being built well that makes

073sense yeah when when we take a look at it i think those things will probably jump out at us right if if let's do the analysis first and then we can um take a peek to see whether or not those people actually were living there in 2018 the last time there was a vote and i guess maybe i should clarify if you could identify the areas that people would be under the current situation would have been voting in 2022 but instead will be voting in 2024. and that way that makes it i think pretty clean and just for a point of clarification that's going to be for the first map that uh five of the board members agreed with a few modifications and then also see so it's on both correct okay correct yes ms

074rawlings um i i have another request um that i still want to try to see if it's possible to um uh to have the quarry creek and the plaza area in the same uh map and um so i wanted to see if i could get three thumbs for the demographer to based on what we've stated so far to see if there's a way to create a third map to accomplish that show of thumbs if you would like to direct um mr chisholm to try to put those two areas together i see one two thumbs i see ms williams and miss rawlings okay so that does not pass okay so uh dr churchill could you um share back what it is that the board has directed uh yes ma'am so um we are going mr chisholm

075will uh have two maps generated we'll call them uh map one and map two and we've looked at both of them here he's been toggling between them uh but they'll have the look and feel of the map that you're seeing currently um uh after he pulls those together i'll do a quick analysis for you so for you in the public so that you can see which areas might have been voting for someone in 2022 and now we're moved to an area which doesn't have a vote until 2024. um and i'm gonna uh publish all of those on the website and keep the the online form open through the next meeting so that uh members of the public have the opportunity to weigh in on uh the changes that are being looked at mr chisholm uh

076just a few requests traditionally if we present a scenario two it it's uh that lives as scenario two from here indefinitely throughout this process our preference would be to call exploration draft c scenario four uh if that's okay with the board so what will so it will be what will the two numbers be uh and yes ma'am thank you and then scenario one the changes that we make that i understood are just this sliver next to tria state drive uh would go back to trustee area two and that revision would result in scenario one so so the two final products would be scenario 1a in scenario 4. is that okay with the board thumbs if that's okay with the board i have a question on that uh miss rawlings um possible to just call it

077one c so could we have one a and one c we can do that um and we would just acknowledge that we skipped one b um i i wouldn't want to confuse anyone in the future i guess but if we want to call it one c it's up to the board as long as we're not calling it something we've already created we can call it whatever you want well that's what i'm wondering if we should start over and start do four and five so it's just cont you know like the public is cons or one uh is being modified and then we're creating a number five generally we try to um if we call it one a it's because we've modified scenario one and in this exam in this example just removing this sliver from

078scenario one it gives some breadcrumbs to the future uh community to see oh it's we adopted one a that's because we started with 1 and we made this little change with with the exploration draft c certainly an argument could be made that we started with scenario one and we changed this area here let me change this area here and so i don't disagree with miss rawlings that we we are adjusting scenario one a second time to to produce this uh but there are some changes in the northeast there's some changes in the cell and that might justify calling it scenario four but um that's just that's just our practice it doesn't mean that the board needs to to do that mr pearson dr churchill for simplicity stake and for understanding of the community state what

079would be the easiest to communicate to them in terms of these tweaks or changes i i i think it's easy for me to publicize for our team to publicize exactly as mr chisholm suggested that map 1a was it was a an iteration of map 1 and that map 4 was newly constructed and i i like the idea of someone a decade from now who's going back to kind of track these things to see what changes we've made over time um has those bread crumbs to get there so i don't think it'll be a problem for me to capture that for our team to capture that and get it on the website and well we have an explanation uh too on the website about those changes or they'll just show up as maps uh uh let

080let me take a look and see what's possible so some of the narrative is difficult to capture but um let's let's take a look we'll have to include some narrative to explain why we're calling out uh parts of town that are moving from one election cycle to another so um let us take a look at that ms rawlings your hand is up yes um i would disagree because the majority of the map is based on map number one and i certainly would hate the public to think that we completely revamped what we presented them originally so i would not be in favor of calling it um area four i do believe a one a and a one c because both maps are are the the um foundation is based on one so i would not

081be in favor of calling it four okay i'm going to ask for thumbs um it sounds like we could either do one a and four are actually mr chism couldn't we do one a and one b could we could we not call this b we certainly could call uh exploration draft c one one b i i my assumption is miss rawlings was requesting it to be one c because it's currently called exploration draft c um if we could call it one a and one b then uh show thumbs mr first of all mr chisholm you're you're fine with that correct i am one b one a and one b is totally fine show the thumbs if you're okay with one a and one b and we have a winner all right okay all right so

082i think we're clear on this mr chisholm do you have any other questions or dr churchill any other questions no ma'am thank you very much mr chisholm thank you for being here and thank you for your patience with us and and for uh your various iterations we we truly appreciate it okay so we now move to the communications component of our board and item 6.1 our report by student representative dalen rose all right can everyone see hear me all right yes perfect let me get my notes open sorry i had it open and then i closed it on accident um all right so i'm from csa so i'll start with updates on csa and cba um so seaside is about to finish finals tomorrow uh teachers and students have all been working hard on getting

083final assignments and all tests submitted uh staff is very proud of hard work that they have seen from their students and then carlsbad village academy will be saying goodbye to 14 seniors that have submitted their graduation requirements four of these students came back for fifth year and finished so the school is very proud of this group um looking at chs it's finals week for them as well and they're planning a blood drive for february 23rd and the formal is set to be on february 5th lastly with sage creek hoop coming will also be february 5th with the theme being night in the city sage creek theatre's high school rendition of chicago is underway and performance dates performance dates are still set to start on february 24th they also had a blood drive today as well

091the district my first point this evening is to remind you of a still incomplete and overdue record request made to the district in august 2019 now over two years ago your hr guy rick grove blew past the 30-day deadline and his work was incomplete in my request i specifically demanded a complete record which includes any and all documents rick keeps in his desk i can tell you as a precipient eyewitness that rick rowe keeps a set of secret records in his desk separate and apart from the personnel files this is an improper practice that he has devised to evade having to tell the truth further rick grove engages in retaliatory practices and does not provide staff notice nor opportunity to be heard when it comes to disagreements it demonstrates a certain kind of sadism that

092i find troubling these practices by your hr guy have exposed the district and its taxpayers to risk for example you've had to retain legal counsel to represent the district in our matter before the state labor commission in my experience a typical legal retainer for this type of matter runs around five to ten thousand dollars instead of taking about 10 minutes to run a complete set of records through a copy machine rick has instead embarked on a stubborn campaign to hide the truth this this is the toxic atmosphere i alluded to in this district when we spoke last time about the lessons you failed to learn after the pacific rim litigation now on a separate note tonight's meeting is the last public meeting before you begin another evaluation cycle of ben churchill's work it's been six

093months since he last evaluated ben churchill at a private location last july there's still nothing published in the record to indicate what standards you used or how ben meets or fails those standards as i have inquired before are ben's performance criteria going to be made public will you disclose how ben does or does not meet these benchmarks will the evaluation process like before be held entirely in secret i will point out that south of us in san diego unified the school board published a detailed list of performance criteria in connection with their new superintendent search this list was published in the union tribune and ben is still not a real doctor those are my three minutes good evening our next caller is 7181 please press star 6 to unmute dear trustees and superintendent churchill my

094name is scott davidson and i'm the parent of a child in cusd in just one week we've seen significant developments on the coveted response policies at cusd last wednesday cdph abandoned quarantine protocols and allowed all students to remain in school acknowledging that quarantines were never effective their new policy can essentially be described as stay home if you're sick which sounds remarkably familiar to what we did before covent we applaud to usd for immediately adopting the new policy which surely relieves a great deal of stress from our staff that have been overburdened with tracking the hundreds if not thousands of students who've had or sat next to someone with the omicron sniffles in the past month cdph also now asks vaccinated students to get tested acknowledging that the vaccinated can still get infected and making the

095idea of a vaccine mandate completely pointless today ali muktad of the infamous ihme covet modeling group stated that omicron will end the pandemic that has essentially turned covid into the seasonal flu today british prime minister boris johnson ended the math mandate in british schools although only teenagers had ever been masked in the uk and on friday the newly elected virginia governor immediately banned school mass mandates adding virginia to the list of 35 other states that do not require masks in school also last friday the cdc acknowledged what many of us have known since the beginning that cloth masks quote provide the least protection studies have consistently shown that cloth and surgical masks are only 10 to 12 percent effective meaning they only provide minutes of protections for kids in a classroom setting but once again

096there seems to be a disconnect between the evidence and our policies instead of acknowledging that our low case rates in schools were clearly not due to the ineffective cloth and surgical mass our state public health officials have decided that our kids need better masks in the form of n95 respirators which are dangerous highly regulated medical devices not designed for or approved for use in children studies also show respirators are less effective than masks due to their inability to fit children superintendent churchill previously advocated to the state over the summer to allow vaccinated students to remove their masks since it is now clear that vaccinated students can quite easily become infected and transmit covid this letter was misguided but the principle remains vaccinated and unvaccinated children are and always have been at lower risk from covid

097than from influenza or rsv so there is no longer any need for a kid to endure any restrictions that impact their learning environment i am asking this board to advocate to the state for our students to get back to the normal school experience they have been desperate for for almost two years help us get the masks off of our kids thank you thank you our next caller is one seven three two please press star six to unmute hello this is kelly laberthon carlsbad resident we greet 2022 with a win in the courts against the california ethnic studies curriculum this is good news in fighting for parents rights for children and against crt seifer and three san diego parents sued california board of education over ethnic studies that included teaching students to recite prayers to aztec

099all happen to be white males my association to power is diminished end quote what is he saying here he says that although he has a doctorate when he is among white superintendents his power is diminished why is that are the white superintendents racist what do they do that is racist he gives no examples is dorsey saying that because they are white they are oppressors we are left to infer that white superintendents are inherently racist and dorsey is a victim because he is dark-skinned this is crt discriminating against someone based on their skin color is illegal if he is being discriminated against he should pursue legal action the racist policies of crt are losing in court trustees and staff stop the political and cultural indoctrination of teachers and children help our children recover from the chaos

100of covid focus on basic subjects our children are suffering because the adults are playing politics the time is always right to do what is right as we heard earlier a new poll from national school choice week shows that 52 of parents are considering new schools this year california parents will have the opportunity uh thank you those who called in uh we now move to item 7.1 approval of the consent calendar all matters listed on the consent calendar are considered by the board to be routine and will be enacted by the board in one motion there will be no discussion on these items prior to the time the board votes on the motion unless members of the board staff or the public request specific items to be discussed and or removed from the consent calendar i

101will be pulling item 7.3 and trustee williams has asked that item 7.6 be pulled are there any additional items to be pulled would someone please make a motion oh no no sorry this is the time for public comment on this agenda item ms garcia please call for public comment if any member of the public wishes to provide public comment on the consent calendar now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item and we do not have any callers for this item may i have a motion to approve the consent calendar with the exception of item 7.3 and seven point six so don't move jones second pearson trustee jones made the motion trustee pearson seconded the motion ms garcia please

102call for a vote uh trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes that passed unanimously i pulled item 7.3 which is the minutes of the organizational meeting because it appears on paragraph 3.4 3.2 that four trustees were not present for the vote of the board president when in fact all five of us were present and voted in the affirmative i moved to approve item 7.3 with the correction samuel pearson uh the motion was made by williamson and seconded by pearson any discussion ms garcia please call for a vote trustee williamson i had some discussion oh i'm sorry i didn't see your hand yes ms rawlings thank you i actually had a small correction as well to the minutes i'm trying to pull it up here the minute stated

103that that the board voted four to one to consider corey creek and the plaza area in the maps as a community of interest and according to the recordings it was discussed that the demographer would produce one map to reflect that at least one map to reflect that but it wasn't adopted as a community of interest so i would like the minutes to reflect the recording rather than what's reflected currently in the minutes okay all right uh i will amend my emotion my motion to include the correction from that as just described by ms rawlings dr churchill are you clear with by what that would mean yes ma'am uh mr pearson would you second my amended motion second pearson okay ms garcia please call for a vote trustee jones yes trustee williams yes trustee rawlings yes

104trustee pearson yes trustee williamson yes that passed unanimously christy williams thank you i pulled item 7.6 since i will be abstaining from voting on this item city of carlsbad is listed on the ap warrant listing and my company works for the city of carlsbad while no material conflict of interest exists out of abundance of caution want to avoid the perception of a conflict of interest may i have a motion to approve item 7.6 so moved rawlings second jones trustee rawlings made the motion trustee jones seconded the motion ms garcia please call for a vote trustee jones yes trustee williams abstain trustee rawlings yes trustee pearson yes trustee williamson yes that passed unanimously we now move to part eight discussion action items part two item 8.1 measure hh bond program monthly update trustees this is an

105information discussion item mr dill thank you president williamson and good evening trustees i have just a brief update and following this item we'll go into the design review for valley middle school but first allow me to share my screen here just a few updates i don't have slides on this but on the financing status we had our credit uh rating review yesterday with standard and pours for the upcoming certificates of participation we expect to receive the rating on that next week everything seems to be moving along we have some a few more legal details that we will be working on which are all standard uh prior to uh hitting the market next month so i'll continue to keep you updated as we zero in on the date when we go to market on uh the

106certificates of financing which will help relieve some of the cost pressures that we have with our current construction projects that we're heading into with phase two um also i mentioned on here program management uh as the trustees know we've reinstated uh the position of director of facilities planning and construction management and we will have final interviews for that position on monday so hope uh we have a good candidate that comes out of that i don't know who's applied or who's made it through the process yet so i'm looking forward to finding out who those folks are and meeting the finalists on monday a quick update on project status i'll show you some photos of kelly elementary a lot of work on the new multi-purpose room building the steel deck has gone in uh so we're

107finishing up on steel work there concrete slabs were poured and we've got framing out on the kitchen extension with hope uh no change on that we're still waiting for the grading permits as soon as we have that uh we'll complete the work on the storm water improvements hopefully this summer and we did do some updates on the uh designs that the board previously gave us direction to proceed with uh so we updated uh the ptas of buena vista jefferson and aviara oaks last week and i had good conversations with all three of those groups and following discussion tonight we hope to schedule a meeting with the valley pta next month to update them on the plans that we're moving forward with we wanted to wait until we had direction from the board before scheduling that

108meeting so we know when that date is and hope to get that on their next calendar so just a few uh pretty photos here just to back up what i just mentioned i get to see this every day as i drive by uh but here's the structural steel completion getting ready for the concrete pour at kelly uh the rough-in of the floor there so you can see things are really coming together at kelly uh and pouring the slab and uh framing out on that kitchen expansion uh phase two timelines i thought i would give a quick update on where we are with uh the projects that uh we currently have underway we have plan submittal with into dsa and the city of carlsbad at buena vista at jefferson we are in dsa we the work

109that we're doing does not require any review by the city of carlsbad so uh so that's not applicable uh avr oaks uh we're finishing up the design development uh looking to get into dsa uh pretty soon for an early fall approval out of dsa valley middle we'll be talking about in a moment and then we're also still working on the crossbar high cooling plan um you know probably the the site that's most exciting uh coming up would be jefferson uh since we know that uh once we get approval from dsa we can hit the ground running on that uh i think we'll see a pretty good amount of work uh starting this summer with buena vista you know we will be held back until we get city approval from doing a significant amount of work

110there so when i say that we could be starting starting in june this would be some of the preliminary work that we would be doing nothing really heavy there because we will be moving buildings and that requires some grading which of course requires the permit uh aviara we really need to wait until we get both the dsa and the city approval before we get started on that so with that i think that was all of the slides that i had so if there any questions on the monthly update thank you miss thank you mr dill do any of you trustees have any questions ms rawlings i just had one question i just wanted to confirm that we had um plenty of applicants for the program manager uh you know uh i'm trying to remember what

111ms austin informed me i think we had nine applicants for that and that was the initial round they go through a screening process and let me just stop this share here so we can see everybody we do have a screening process that they go through and oral interviews and then the finalists are then presented to me so because we're in a merit district i don't have all of the details but i do know initially they had nine that they screened at least in to proceed to the next phase are there any additional questions thank you mr dill uh now is the time for public comment on this agenda item ms garcia please call for public comment any member of the public wishes to provide public comment on this agenda item now is the time to

112do so if you are on the line press star 9 to indicate you wish to speak on this item and we do not have any callers for this item thank you trustees is there any discussion all right we will now thank you mr dill we will now move to item 8.2 fmp phase 2 modernization project final design valley middle school trustees this is a discussion action item mr dill thank you again and i'll also be welcoming josh eckel of alpha design studio who will be walking us through uh through the final iteration prior to your approval where we'll we'll begin uh the process of preparing plans for dsa submittal uh i'll start it off and then i'll turn it over to josh and i think i i end it here so let me start the

113screen again okay just as a recap of where we last left off uh we last spoke about valley middle school at the september 29th uh facilities uh study session with the board um we talked about some of the challenges that we had and uh the uh some of the thoughts that we had gone through with modernizing that campus and how we were pushing up against the budget um particularly with replacing the eighth grade village and so that was something that we needed to talk about taking off the table of replacing with a brand new building simply because that would have eaten up the modernization budget for the entire school so we had to shift and this was the discussion that we had of doing a campus-wide modernization uh that focused on improving as many classroom

114spaces as possible and uh that that would provide parity and also lead the way uh for the the following modernizations that we will have at our at our other two middle schools um of course we're still looking at adding a steam collaboration space uh moving uh the special ed area into the core of the campus um doing some work on the on the gym ventilation and addressing accessibility issues so since that time mr eckle has done some further site exploration since we had to shift to modernization of those existing classroom buildings in the 8th grade village rather than replacing it needed to do some additional work to make sure that that was uh that was feasible and he can talk about uh any any how that might have informed him along the way to bring

115the the set of designs to you but what you're going to see tonight is essentially what you saw on paper back in september uh we just have more information now than we did back then so i always take you through the same uh the same counts that we have been showing you all along the way uh with just a little bit update on the uh the current enrollment at valley middle school so you can see that that we're past our peak and past our projected peak in terms of the campus and so with this i'll turn it over to josh because this is uh it for him and josh just let me know when you want to advance slides okay perfect all right thank you mr dill good evening president williamson trustees dr kirkpill community

116partners it's always great to be here and present projects to this board and this community so thank you for the opportunity again like mr dill mentioned um the slides that you're going to see should look fairly familiar um they are what you saw in september we are just getting deeper into developing the design and furthering into our construction document phase um so the slide that's on the screen right now is our overall site plan just to orient everybody again to this plan at the top of the screen we do have magnolia avenue along the right hand side we have valley street so that should orient you as to where the the campus and what these images are showing you um on the left hand side we do have our legends that's color coded to the

117buildings that are sewn on the plan you will notice a lot of the orange color um that is our light modernization that is very typical of what we're doing on this campus um and as you see in subsequent slides we'll really dive into what we have developed and determined to be light modernization in the different spaces you also see we have some areas of heavy modernization those are in indicated by the red those are really where we're we're removing things down to the studs down to the framing and those are typically occurring in our restrooms and in some spaces that we're changing function so our restrooms that we've noted on campus are deficient in the ada standards and so those areas we will be completely removing the fixtures and finishes and i'm rebuilding those on

118the interior to bring them up to current codes we do not have medium modernization on this this scheme but we did leave that on there just for transparency because we did at one point have medium modernization we do have building demo as we've talked before we are going to be removing or proposed to remove some of the eighth grade village and then we do have areas of site work and that site work is ever developing as we continue to go out to the site and determine areas that require ada accessibility upgrades um drainage remediation or upgrades to the existing parking to bring those um into current compliance okay next slide please all right and this is just a zoomed in and large site plan of what we just talked about so again we're really focusing

119on the campus core we're not doing any work in the field area we're not doing any work up in the existing administration building um again with this flight it's a little bit easier to see what mr dill had mentioned about our relocation of the special ed program so you can see that's occurring um right there in the the seventh grade village right kind of in the center of the campus there so we really are integrating that program to the entire campus all right next slide please okay so this slide is a little bit different than what you've seen before but some of the feedback we got in the special board meeting or in the special presentation in september was that the board requested to see basically a list of all of the scope and that

120was if we took the facilities master plan and we followed all of those scope items what would this project have looked like and then we went through and we actually lined out the items that were de-scoped based on budget based on change of programs so um this is really a good record-keeping slide of where we came from and where we are now um so you can see in the sixth grade village we have light modernization in the classrooms and the support spaces and that also occurs in the seventh grade village um in the eighth grade village we have the light modernization and and heavy modernization in a support space but you can see that we've de-scoped the new classroom construction and support spaces the site restrooms have always retained their heavy modernization status and in

121the kitchen facility we have no scope so we de-scoped satellite kitchen remodel and we also de-scoped new construction of the kitchen facility the same can be said for the administrative offices we've removed scope from there we initially had heavy modernization on an expansion in that area and those no longer a part of the project building 100 again you can see that we de-scoped special ed relocation as well as the coral and dance program the light modernization in that building the steam building we do continue to have light modernization and that's that steam collaborative space that we've been talking about and so we are still doing work in that building however we are descoping the conversion um the art conversion and that was kind of the domino effect of moving the special ed program to building

122100 um and then the art program then now moves to the steam lab so because those pieces didn't move that way we no longer are converting that area in the steam building to the art conversion in the gym in the mu we've can we've continued to have the hvac upgrades but we did de-scope the band room expansion and the heavy modernization within the band room and then in the library we described light modernization there is no scope in the the library at this point and then under site work we have continued to retain many of the items we had in italy and those are those are unfortunately not some of the prettier items that happened but they are some of the necessities on the underground campus utility work we do have some compliance issues with

123the existing gas service roofing upgrades storm water mitigation we are going to be demoing and safing off existing reloads um and that's our that is occurring in the eighth grade village and we always have our required ada site upgrades um and then we have the foul ball and safety netting which occurs along the southern edge of the campus and then because we are touching older buildings and older building materials we will have hazardous abatement that will have to occur all right next slide please so this is where we kind of dive into what does a light modernization mean and so when we talk about light modernization particularly in our standard classrooms we're talking about replacing the flooring replacing ceiling tiles replacing case works in the cabinetry um the teaching walls we want to upgrade our

124lighting so that we have better lighting within these these spaces uh technological improvements and we want these clusters to be able to function in our current technology environment keyless entry and then interior painting and or repairing of the vinyl wall covering so you can see that occurs in our standard classrooms and it also occurs in our science classrooms in our student collaboration spaces the light modernization is defined in a very similar manner the difference is we are going to be removing some built-in items such as the built-in tables and those pockets in which the table is recessed into them but we are going to be doing a lot of the same thing it's a lot of fixtures a lot of finishes those cosmetic upgrades to these spaces within the classroom villages our office areas those

125also will receive light modernization and those would be consistent with the light monitors been in the classrooms the special ed room conversion um fortunately there is not a lot of infrastructure required to support the special ed program so it actually falls into the light modernization category as well so after our analysis and our discussion with the special ed program um you can see that the light modernization again is very consistent with what we're seeing elsewhere on the campus and the steam lab follows suit as well with upgrades to the fixtures and finishes with flooring and ceiling tile casework uh specific for that program um including storage uh replacing lighting because again we're we're providing a specific function um a speed lamp collaborative space we want appropriate lighting for that function when we get into the

126restrooms when we talk about heavy modernization it's similar to what i said earlier where we're talking about demo um of the entire space on the interior so we're removing it all the way down to the structural framing and then we're building it back up and we are establishing the appropriate clearances and requirements for that space all right next slide please so this slide is another um recap slide from our september meeting at that time we had a lot of fluidity in terms of our counts of our spaces so we've gone and cleaned that up a little bit we've done a number of site visits um to to correctly quantify what we have out there and you can see that we'll be removing four classrooms from the eighth grade village so that brings our classroom count

127from 42 down to 38. all of the other spaces will stay similar um in number so you can see that we've corrected some of the inconsistencies we had back in september and we've identified these spaces and their their accounts accurately from what the current situation is to what the proposed design is i mean you can see those flash those four classroom removals carry all the way down to the total whereas we had 129 room counts currently we will be reducing that to 125. all right next slide please and this is our current design schedule so right now we are in our design development phase soon to be entering construction documents we will be looking to complete those in the early part of the summer where we will submit to dsa our dsa review process is

128looking to take between july and december so about six months is what we're looking at we are not required to go through the city of carlsbad because of the scope we are not triggering any any requirements to the city review and then we're estimating a bid period between january and april of 2023 with a construction phase tentatively scheduled to start in june of 2023 and go just a little bit over 12 months or just a little bit over 14 months i'm sorry uh next slide please and then at this time i think it's oh i'm sorry i was going to turn it back over to you you took the words right out of my mouth perfect i i just about cut you off i just wasn't quick enough on the mute on the unmute um

129this is where i'll jump in and and remind the board of where we started and where our discussion was back in september um and as you will recall um you know we struggled with uh with the gap between uh the initial budget and where we and where we currently were um i'm happy to report that that the uh 30 million has come down slightly since you last saw it in september but based off of the earlier discussion we didn't have much left to take off the table if we were to accomplish this campus-wide refresh and so you know the budget is what we have here um you know there are some contingencies uh that are built in that you know we always hope to beat uh but we build those in uh you know just

130to make sure that that the budget is correct and that we do have room for unforeseen conditions along the way and that we don't exceed it once we once we get underway um but this is what it is and so um what i would recommend is that the board uh or i request is that the board approve the final design um with the additional budget um allocated from phase two funding and that uh the way we accomplish that is by the augmentation of the certificates of participation uh issuance that we will have next month and with that uh we are at questions thank you very much mr dill and mr eccle trustees do you have any questions ms jones then ms rawlings thank you and thank you both for the presentation i just needed a

131quick refresher because i was sort of toggling between the um updated projects by phase and and mr eckel clarified one that was helpful on the um d scoping of some of the projects with the mu and and the arts building but mr dillon reviewing the scope of phase five we've listed valley vapa classroom construction as one of the projects in phase five should we get additional funding would the d scoped items listed from uh this list uh be included in that or or were the was there a different scope in the phase five project i know we're not quite there but i think in talking to some parents uh recently there's concern about not doing anything to the valley vepa and so i kind of want to hear from you what what will your response

132to them be thank you for asking that i was i was anticipating somebody would ask me this and and you know anything that was removed from the scope on phase two uh would still be in play for for a future phase so you know as we get into you know through the uh the initial phases across the district when we come back and really phase five is circling back to our campuses with remaining work with the funding that is remaining um that would be a time when we would once again look at the remaining work that was identified in the 2018 facilities master plan and then prioritizing that within the funding that we have and so you know what i would say is you know none of these things are gone forever because they didn't

133happen in phase two they can certainly be revisited and discussed in uh in future funding phases thank you ms rollins thank you um and thank you for that presentation i really appreciated that document of the descoping that made it super clear and it was very easy to track um i did want to ask about and i brought it up in september about the kitchen and nutrition services of how things have expanded how do you plan on addressing that at valley and at the rest of our schools with the expansion coming along certainly and i've had a lot of uh discussions with our director of nutrition services about how we're how we're handling the uh increased serving across the district with the change to uh you know the universal luncheon and breakfast program and you know

134we're still in a mode where we're looking to see where the the demand shakes out um it's growing every day and uh but at some point you know we're going to see where we kind of reach equilibrium or a status quo with the demand and you know that i think is really going to inform where our kitchens need to go and you know with valley middle school i was i was out there i was doing noon duty uh last week um so i got to watch lunch and and was talking with the staff there and then the campus supervision and you know what they were saying is you know um while lines are long at the beginning some kids hold back and then they come in when the line dies down and so you know

135they know some of them know to wait and some of them just want to get in line right away and and so i was able to see that you know every student who wanted a meal was was getting through the line during the lunch period um with handling the demand there um you know since we're not going to the concept right now of building the um you know a larger kitchen there we have the ability with the modernization that happened across the street at magnolia with a beautiful kitchen there that has some additional capacity so we could produce meals at uh at magnolia that we could take across the street you know temperature control and and all that um over the valley to meet that demand if we needed to if we didn't have the

136capacity in kitchens there at the middle school um so you know we're i don't want to say we're taking a wait and see on nutrition services but we talked about this with aviara oaks elementary as well you know that we were concerned about proceeding with kitchen modernizations right now when suddenly the world has changed with the expansion of the overall nutrition program across the state so i hope that answers your question just as a follow-up um so it sounds like even though we're taking it out of this phase that it could see some priorities as a as a larger district-wide um project is that what i'm hearing you say yeah i that that's one of the things that we've been talking about internally is you know would it be appropriate to look at the budget

137for all of the kitchen remodels that we had planned and really looking at it district wide but it's too early to really go there yet again i think we need to get into a normal year and we also need to see when we kind of flatten with our demand you know there's going to be a certain number of kids who will eat lunch every day and a certain number of kids who will never eat uh school lunch and we need to find out what that number is you know once once they get used to the world of not being charged for lunch but but those are some of the thoughts that we have but nothing that i really am ready to bring forward for discussion ms williams thank you and i also appreciate the slides

138um as well showing the project the descaling so that it's it's clear what's being removed what's um on the project but my question is um i'm looking looking at the the demolition of the four classrooms and the eighth grade area is that going to have any impacts um with classrooms size and having enough students in the classrooms or having enough classrooms for the students yeah well you know with each of our our teams on each of our campuses here we're really looking at you know what's the right size for the campus and it always hurts to take classrooms away but those are always the last thing that we do on on any of our projects because we're typically using uh excess classrooms to move students around during modernization projects um and so if our enrollment

139should change between now and the end of this project or our demographics and projections change we could always leave them in place we've had this discussion at aoe as well but but in looking at those prior peaks that we had and the current projections that we have for the future it would suggest that we have excess classrooms and so as as some of these older modulars you know go beyond their lifespan you know rather than rehabilitating them if the enrollment suggests we could remove them ms jones thank you that brought up a question that i had when i was speaking with um staff valley about this particular modernization um the question was and we've walked through some of the modernizations that magnolia in particular the speech and language room could you um have staff describe

140or maybe um mr eckel can describe will it be similar and when it's finished to what the i don't know if you know which um uh modernization at magnolia i'm talking about but it's there's i think the speech language lab is what they said but the the area the portable will they in the end look like that for valley unfortunately i'm not familiar with that particular campus modernization or what the finished product of that is i'd be happy to go out there and take a look and we can start to tailor our design to mimic that i can tell you that in the past when we have done this type of refresh on modular construction they do have a tendency to look like a new modular has been brought out so there's refresh paint there's

141refreshed finishes so it does give the feel that it's um the proverbial you're not putting just lipstick on a pig we are really actually going in there and making um these look new with brand new carpet and and finishes um and again if there's casework that gets provided in these or if there's casework that needs to get replaced it's new it's not just putting a countertop on an old base cabinet so um while i'm not familiar with that that is our strategy when we do approach these types of projects okay between that one and then of course the the rehab or refurbs that we've done at kelly have been really great too so just as long as you know we're at that level equivalently or better for for these this this area in particular that

142that would be of interest to me and if and to josh's point if you think about magnolia you think about kelly and if you're satisfied with that two separate architecture firms now we have a third one um and you know we're all headed towards the same consistent end product thank you um we will now move to this is the time for public comment on this agenda item ms garcia please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item and we do not have any callers for this item may i have a motion to approve the final design for valley middle

143school for submission to the division of the state architect some of your drawings ron trustee pearson made the motion trustee rawlings seconded the motion discussion seeing no discussion ms garcia would you please call for a vote actually i have a quick um i'm sorry i missed you with your hand again yes that's okay no i can't i was late with it uh quick question on the pta meetings how will the board uh hear that feedback that you get from the parents and staff from valley after they review this and i can give you a recap of how that meeting went okay and if they have concerns or desire for changes will there be an opportunity to do that at this you know i think that if if there's feedback and suggestions we can take that

144into consideration because we will be in the final design development if it's you know choices of finishes and things like that you know those are things that we can work through but if it's um you know throwing out the plan and coming up with something new um that is something that i would have to have a very serious discussion with you before we could commit to anything like that so you know i can certainly um you know reflect any of the comments or feedback that i receive in those meetings with the board okay thank you ms garcia please call for a vote student dalen rose yes trustee jones yes williams yes trustee rawlings yes trustee pearson yes trustee williamson yes that passed unanimously trustees there's been a request for a brief recess it's 8 14

145let's reconvene at 8 20 in six minutes thank you welcome back we now move to item 8.3 substitute teacher compensation schedule trustees this is a discussion action item mr grove substitute teachers are unsung heroes and are helping keep schools open across the state county and district we've spoken before about the general labor shortage which has been exacerbated by covet and despite the governor's best intentions with his executive order recently which reduced the requirements to substitute the major period of entry still remains and that's a bachelor's degree last week one of our neighboring districts significantly raised substitute rates and staff felt that it was appropriate and necessary that we match suit or lose our substitute pool to two other districts during this month we have averaged 20 unfilled or more subs per day and we fear

146that we won't be able to keep schools open if we don't do something about raising raids um well that's it thank you mr grope did you have a there was there's not a slide or something that shows what you are looking at raising the rates to no the item is uh in the agenda itself we're recommending raising the general education substitute rate for 250 dollars per day special education substitutes to 280 a day and general education long term substitutes to 280 a day effective on the 11th consecutive day in any assignment and in addition to that our 500 loyalty bonus remains in effect and that is a bonus paid to substitutes who serve 100 or more days in a fiscal year with us to thank them for their loyal service thank you trustees do you

147have any questions mr pearson mr grove i we recently got a comparison some of our contiguous districts i think it was san marcos was 185 and oceanside was 165 and 180 long term and i think vista was 200 on that my question for you is this is i understand about being competitive and what san diego did but those other districts have not raised their rates how do you explain that they haven't had time to respond we were fortunate and that our agenda had not gone to print at the time of the san diego board meeting last week but san diego unified is paying 250 a day as well and there are other districts in the county that are paying over 200 as well but you're right up until this point most of us in this

148area have been in the same ballpark but uh the game changed last week i'm afraid miss jones i had a quick question there was an interesting point brought up about recruitment um and any barriers to recruiting substitutes that we could impact at least when we were at the school services presentation today do we have things that we could review in terms of hiring that are creating any other additional barriers or is the only barrier right now the state's requirement for a bachelor's degree yeah i believe that's the significant hurdle now there are minor exceptions there is a prospective teacher permit which has a more short-term service available that's for a senior in college um unfortunately often their work schedule or our schedule doesn't correspond to their their class schedule very well additionally part of the

149executive order was the ability to utilize um student teachers who have not yet completed their requirements we're doing that currently um we're we're basically using anybody that you know that meets the requirements currently recruitment is you know is an interesting challenge because generally speaking you're recruiting regionally somebody is less likely to drive a great distance to work in a substitute position and at the price of gas you know that that has a factor as well but now that our neighbors you know or i've raised the rate i just don't see it see us being able to not not do the same and i have a follow-up to that in terms of the retirement um part of the executive order will that how are we reaching out and recruiting our own retired teachers yes thank you

150and are we getting a good response i guess from those efforts we've had some response we sent an email out as soon as our agenda went to print uh you know to our retirees our recent retirees and share with them the executive order the executive order did two things that it eliminated the sit-out provision of 180 days but last year's retirees are coming up on that now so that really wasn't a significant issue it also eliminated the earnings limitation currently if somebody retires in the calstrs system they're limited in how much they can earn in a given year in a school system such as substituting and if they exceed that earnings limitation they have their retirement deducted dollar for dollar for every dollar they earn so that can be a barrier to entry um but

151generally not not in a substitute capacity that's sometimes an issue in other types of work but but we communicated both of those changes to to substitutes i'm sorry to recent retirees and we'll continue to beat the pavement with that thank you you're muted president williamson mr pearson thank you um mr grove um i don't doubt with san diego raising that rate we don't we are not currently competitive with san diego so what happens to vista san marcos and oceanside um right now with their rates are they not attracting any substitutes everybody's experiencing shortages i can't speak for any of them as to what their intentions are you know when you look previous to the recent san diego rate they they were basically in the same range as ours so it's hard to say it you

152know being the same rate it doesn't give us competitive advantage being lower puts us in a position where we simply can't compete so i would expect to see rates going up across the area okay thank you ms rawlings i mr gruff we approve this today um would it go into effect immediately or and or is it retroactive at all i didn't recommend retroactivity but it would go into effect immediately tomorrow and you'll also notice i did not specify a sunset date as we have done with prior increases and that's mostly because we're going to need to reassess the market this summer anyway sun setting this rate to what our former rate of 115 dollars is probably not going to play it any longer in light of the the increased minimum wage and what you know

153entry-level positions in other sectors are paying so we'll have to do a complete analysis this summer and check the market so this is this is effect effective immediately tomorrow dean no further questions uh now is the time for public comment on this agenda item ms garcia please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item and it looks like we have one caller for this item as noted on our agenda no individual presentation shall be for more than three minutes and the total time for this purpose shall not exceed 20 minutes ordinarily board members will not respond to presentations and

154no action may be taken however the board may give direction to staff following a presentation speakers are asked to state their name and indicate whether or not they live within the boundaries of the school district when we call the last four digits of your phone number press star 6 to unmute you will have 3 minutes we will have the timer on the screen and will mute your mic when your time is expired the first caller is two three five five press star six to a mute we're on the record yes madam chair may please the board jb scranton here san diego's number one substitute teacher and foster parent and i do not reside in the district i've been employed as a substitute in this district since 2013 so the matter before you now does affect

155me and my colleagues directly in my over eight years with the district carlsbad has always lagged behind the rest of the county's major districts when it comes to substitute teacher compensation this has apparently led to a crisis within the substitute pool to wit you apparently cannot attract and retain enough qualified substitutes in carlsbad in the last six months since august you've hired a total of 90 new substitute teachers with nearly 30 getting hired in the month of october alone this is desperation without precedent in recent memory in the comparable time period uh the six months from august to january last year you hired only 25 substitutes but that's during the covid crisis so that data may be an outlier so if you compare the period prior still august 19 to january 20 you hired 64

156substitutes if that year is an appropriate baseline our current year is hiring 50 percent more substitutes than usual this has the hallmark of a crisis there are two ways you can attract and retain more teaching talent one way is higher compensation and 250 dollars a day does go far in making a difference but rather shower you with in management with gratitude i prefer to ask what took you so long and will this be retroactive the second way to retain talent is to eliminate the toxic work environment that your hr leadership has created i will refer you to my remarks about rick grove's penchant for sadism made earlier this evening in this time of crisis petty bullying has no place please do not balk at the estimated price tag for this compensation proposal a hundred thousand

157dollars represents not .7 but .07 percent of the district's budget of roughly 140 million dollars this is a drop in the bucket this is a rounding error one way you might consider funding this proposal is to cut executive compensation if you cut each of your number one and two executive salaries by 50k each this would be easily funded the mechanism to make this happen is through a strategic breach of contract the details of which will exceed my three minutes here but it can be done this is late and coming carlsbad has a habit of producing late work good evening may i have a motion to approve the substitute teacher compensation schedule as presented so move jones second rolling trustee jones made the motion trustee rawlings seconded the motion is there any discussion mr pearson hear

158actually the the competitive piece of this and the need absolutely um i will be supporting it but i have some concerns about monitoring the other districts see if they're going to ramp up their rates to the same rates that started with san dieguido and if they don't i'd be interested to see how their recruitment is on substitutes and how their numbers look thanks any other discussion ms garcia please call for a vote student board representative dalen rose yes trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes that passes unanimously we now move to item 8.4 unvaccinated volunteer plan uh trustees this is a discussion action item mr grove thank you on the on august 11 2021 the cdph issued a public health order which we remain under are subject

159to and the key components of that public health order included that all schools must verify the vaccination status of workers unvaccinated workers must be tested at least once weekly and schools must have a plan in place for tracking verified worker vaccination status records of vaccinations verification must be made available upon request to the local health jurisdiction what this what this necessitates is that we retain those records in a secure fashion the order applies to k-12 institutions as we are and most notably worker refers to all paid and unpaid adults serving in school settings including volunteers next slide please the cdph initially published guidance in september of 2021 which suggested that schools should limit non-essential volunteers in the 20-20-21 school year in fact no volunteers were allowed in our district and most districts for that matter

160at the august 18th 2021 meeting the board of trustees we presented a plan that would require all vacs and all volunteers to be vaccinated in the current year and on september 22nd we published a new volunteer management process including a centralized verification of vaccination status and began processing volunteers to resume volunteering in classrooms and field trips should be noted that according to our attorneys the right for parents to volunteer on campus is not absolute and when health and safety circumstances weren't we may limit or ban volunteers as we have in the past and uh currently parents and guardians who are not fully vaccinated can continue to volunteer in a number of ways just not interacting with staff and students on campus next slide since that september 21st or september 22nd volunteer screening process implementation we've

161processed 2009 volunteer applications the vast majority of which have been approved and of those not approved most are either duplicates or incomplete or submitted by staff who don't need to go through the verification process as they've already exceeded the verification standards necessary for subs and then there were 95 applicants who were not vaccinated but went through the process anyway to let us know that they were interested in serving our students should we offer them the opportunity next slide and then finally at your last board of trustees meeting you gave staff direction to bring a plan for the board's review and discussion whereby unvaccinated individuals will be permitted to volunteer on campus under the conditions specified in the public health order we specifically asked for information regarding testing how it would be monitored and any related

162costs excellent some of the considerations in addition to those you suggested that we've considered was the volume and nature of volunteers whether they'd be daily volunteers weekly monthly one-time volunteers a process for reporting test results how we would get those test results in a timely basis management of those results and then a significant consideration is privacy issues associated with medical information of of key staff and volunteers excellent so our process that we're recommending based on your direction is that we revise the volunteer application form and bifurcate the approval process currently volunteers submit a form online which includes a number of questions including a an acknowledgement that covered 19 there's risk associated with it they indicate criminal records we do a criminal background check on the national sexual predator database and then everybody who meets those

163vetting we then check for the vaccination status if in fact they're vaccinated they go on an approval list which is shared with the sites and is updated in aries the key advantage to that being that whereas in the past they were vetted by individual school sites and had to go through this process for each site they may have a student at or each year their student moves up to the grades we have a centralized process and once somebody is vetted and approved they remain so for the duration of their students their tenure with us so that is the process which is in place we would then bifurcate it and have an additional channel that once somebody has been vetted and gone through the the form process if they're unvaccinated they then would be subject to

164weekly testing or testing prior to visiting campus the challenges associated with testing as you can imagine are the the volume of testing how we would retain those records and and keep them private and we have a good process in place currently for students and staff that we've contracted with an independent third party that's inspire diagnostics who as you heard earlier tonight they were lauded for their availability for testing for our staff and families and communities and um and that process exists currently for staff and students and we think that that could be replicated for volunteers as well currently when an employee or a student tests those test results are then placed into a dashboard and the access to that dashboard is restricted on a need to know basis so for example for staff our personnel

165director and i both have access to all of those test results site by site but student test results are only available to the site at which they attend we would then have a new dashboard for volunteers and that testing data would be made available to the site administrator and administrative assistants at those sites what then would happen is an unvaccinated volunteer would submit to testing at one of our inspire clinics between three and six days prior to volunteering and then upon arrival on campus to volunteer the site designee that would be the administrator or the administrative assistant would then consult the dashboard for the volunteers testing status to confirm that in fact they've tested uh negative the reason for the three to six day window is that currently under the pcr testing that we're implementing

166it typically takes about that long to get results back 30 hours to to 48 sometimes 72 so a window of three to six keeps us legally compliant where they have to test within the week that they're volunteering but it also ensures that we would get the results on a timely basis in order to to clear them to be on campus the beauty of this program again is that it's analogous to the one that's already in place there's not a lot of effort that would need to go into ramping it up we'd have to reach out to inspire and uh determine what additional staff if any they would need um there's no out-of-pocket cost to anybody who who takes advantage of the test so that's not an issue there in fact is probably not a dollar

167cost to the district however there is an opportunity cost that being the time associated with site administrators or administrative assistants having to check the database as as a volunteer arrives on campus next slide that's it in a nutshell happy to take any questions from the board thank you very much mr grove trustees do you have any questions ms rawlings thank you is there anything in the cdph that refers to non-essential volunteers visitors on campuses no they don't define non-essential that's that's a term that's really left up to the discretion of the school district prior to omicron ramping up another a number of other districts had begun to once again welcome visitors and volunteers on campus we've actually invited student teachers back this year which we have not done a prior year but no there's not

168a specific definition okay i guess i did see in the cdc guidance that does talk about non-essential uh visitors um but there's not anything equivalent to the cdp on the cdph not that i'm aware of okay schools should limit non-essential visitors okay that's that's what i was wondering about okay and so that still exists or no yes this health order is still in place yes okay um and then i have another question just a little bit should i go ahead and ask my second question or wait for another trustee yes sorry go ahead thank you um you had mentioned that um there would be time involved um how what does that look like as far as a site administrator and will there be an additional check-in or you make an appointment when you volunteer for

169a particular classroom that sort of thing or how would that work on individual campuses it probably is largely dependent on the number of unvaccinated volunteers a campus has that want to provide service as i indicated on a prior slide we had about 95 of our parents or volunteers suggest that they would like to participate should we offer a program like this it's it's undetermined how many more or might be interested in doing this it perhaps the the trouble of going through a testing process might be enough to keep some of them away so it's really it's it's impossible to determine the number um and the amount of time spent is going to be largely dependent on that um considering that just on the natural our community is the majority of our community is vaccinated one

170might you know suggest that that would be the same with our parents um so if you consider the normal flow of volunteers in a typical year pre-covered year filing through the the office and going through the visitor management system uh you know perhaps it's it looks like that so it's it's it's difficult to say let me ask a follow-up to that mr grove volunteers who are vaccinated who have been cleared going to campus now do do the administrative assistants or principals need to check them on the database they do but i would imagine that it's you know a one-time check if you've got somebody who's volunteering regularly and you know that they are cleared because currently our clearance is good it's once you've gone through the process you are clear to volunteer it probably isn't

171something that has to happen each time whereas if you're unvaccinated and have to test within a window prior to being on campus it would require that additional verification okay thank you very much if there are no further questions now is the time for public comment on this agenda item ms garcia please call for public comment any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item it looks like we have one caller for this item as noted on our agenda no individual presentation shall be for more than three minutes and the total time for this purpose shall not exceed 20 minutes ordinarily board members will not respond

172to presentations and no action may be taken however the board may give direction to staff following a presentation speakers are asked to state their name and indicate whether or not they live within the boundaries of the school district when we call the last four digits of your phone number press star six to unmute you will have three minutes we will have the timer on the screen and we'll mute your mic when your time has expired the first color is five five five five please press star six to unmute good evening can you hear me yes we can good evening my name is rachel morenowatt and i'm the cuda president and i would like to speak against this plan to allow unvaccinated volunteers in schools at this time given the precious little time our friend office

173staff has right now while they're busy tracking positive cases and covering for each other during absences the last thing they need is yet another set of people to track could they do it undoubtedly should they do it no teachers are not demanding more volunteers this is not an area of need where the approval of this plan will result in better run classrooms or safer schools i have listened to every school board meeting for 22 months and i've heard the desire from a segment of our parent population to be able to volunteer however again teachers do not need this office staff does not need this the extra burden this will place on a school site outweighs any benefit to the community a consideration which be it should be the barometer of any such decision thank you

174for your time thank you since i made the request last month i'll make a motion so we can discuss this item i move that we direct staff to take the following four steps one revise the volunteer application form and bifurcate the approval process so unvaccinated volunteers can be screened and put in the system two start the screening process three reach out to inspire diagnostics to obtain a cost estimate for managing the testing and creating a dashboard and four at the february board meeting bring this agenda item back so the board can either direct that it be implemented immediately or establish a metric under which it could be implemented is there a second to that motion pearson second trustee williamson made the motion trustee pearson seconded the motion discussion ms jones thank you and thank you

175for bringing this item to have this discussion i wanted to take an opportunity to share with my fellow trustees that i took an opportunity to call and speak with a number of our administrators on the site level to determine the demand that they have on their sites as well as the process uh that was being proposed and whether they had a chance to review it and in what position do they feel that they're in to execute the process and 201 they said that they're stretched very thin right now and the thought of adding more to the plate of the front office staff and and the tracking uh was onerous um of course they welcome parents and they want the opportunity to welcome you know every volunteer back on campus but the few number of volunteers

176they've gotten because there's been a number of volunteers who've not come back yet and are waiting until conditions improve especially because the goal has been to keep kids and teachers in in classrooms in person versus you know other districts that are starting to close in other areas because they lost staff and that's not to say you know i my follow-up question with all of them was do you think it would be prudent to take away all volunteers and all of them agreed in particular both of our middle schools said no not at this time that the protocols we have in place are working the number of volunteers we have are primarily for one-off like uh field trips that are helping with transportation and that uh when i asked have they had contract racing issues with

177volunteers that have been associated with contacts you know to our students they they all said no however so at this time i'm i'm reluctant to consider moving forward i appreciate the administration as you've described it trustee williamson i think that that's prudent and i look forward to reevaluating it again in february thank you ms rawlings thank you um i i will be voting no on this um action item um again i just don't think that uh at this time we need to have what would be considered non-essential volunteers or visitors on campus right now i do think folks are stretched thin i mean when we have mr dill telling us he's working uh the the noon duty um i think that's evidence that there's we just can't add something additional onto the plate and especially

178when there's very few folks that are um wanting to that have expressed interest in doing so so i will be voting now uh thank you dalen um i also would be voting no um for similar reasons but also with some differences um with pcr tests and the kova tests in general they haven't been super accurate lately there's been research going on showing that a single test often isn't completely accurate and then with bringing more people on campus then you're increasing the possibility of spread and when the focus is to be able to keep all of us in person and to keep that i think it wouldn't be the best option right now but i also agree that we should revisit it in the future thank you very much for your input appreciate that ms williams

179i'll i will be voting no on this um i do not want to add more to the plate for staff or site administrators but i would be interested in later on either to delay the implementation or revisit it in a few months thank you all right is there any other discussion all right ms garcia please call for a vote student representative dalen rose no trustee jones no trustee williams no trustee rawlings no trustee pearson yes trustee williamson yes that pass is uh that that vote is uh denied it is two to three uh we will now move to item 8.5 updated procedure for public participation at board meetings uh trustees this is a discussion action item i'll turn it over to dr churchill thank you trustees uh we're bringing this item back there we go

180if you recall in november trustee williamson asked that we bring some draft language about public participation to the december meeting we did that after presentation review and discussion trustees made some recommendations for revision which we're bringing back this evening so attached to your board agenda were four items or four exhibits for you to consider what i'm going to do now is quickly move through just the changes so i'd like to highlight those things that were different from the version you saw in december the first exhibit um is general information and there are no changes to to that exhibit uh i did just want to note and call out here on the slide that uh we are intending to hold in-person board meetings at either the performing arts at preferably the performing arts center at stage

181freak high school if that's booked we'll go to the cac at carlsbad high school if they're both booked then we'll move to to look at our multi-purpose rooms in our middle schools exhibit b is a statement on face coverings at board meetings uh this has been updated to reflect the current cdph face coverings directive which uh states that through february 15th there's a universal indoor mask requirement so uh we'll modify this exhibit to be in line with whatever the face covering directives of the day happen to be exhibit c is how to provide public comment um there are several changes the first was that we added a bullet bullet 2a indicating that the board president will um redirect speakers if they're not speaking to the appropriate item we modified bullets 3 and 3b to include

182a call in feature for folks who for whatever reason aren't able to come or choose not to come to the board meeting in person they can call in and provide public comment via telephone we also in this exhibit added bullet 4d this is copied directly from our board bylaw which which says that with um uh board consent the board president could adjust the time allowed so so in other words uh could increase the time allowed for public input and that was per your direction last one is exhibit d we simply retitled the exhibit to call it additional information and we wordsmith it a bit so that the wording that each phrase incorporates a parallel structure so that's it i'll take questions uh following public comment then uh we would request that you uh approve those

183documents is there any questions ms rawlings thank you um uh how will uh items such as face coverings be enforced that was not addressed and i thought we had that conversation uh you we did have that conversation and that's something that we're going to have to bring back to you at a at a future date any other questions yes mine isn't on the mine isn't on the face coverings go ahead well so i just want to be clear that if we um vote in favor of this without the enforcement mechanism and then are not in favor of the enforcement mechanism how do we square that yeah i understand your question um so so you're saying trustees may not be comfortable approving it without knowing how the face coverings requirement would be enforced or any public

184health because this is obviously not just this specific instance but any public health order how would we intend on enforcing those rules yeah and um i appreciate the question and i recognize the challenge that that this may present for considering this item this evening but we're not prepared to present a comprehensive plan for the enforcement of public health rules at public meetings not at this time ms johns yes it was actually a process question um there was an amendment that i would like to make to one of the items uh related to the speaker's language would that be best to do after the motion has made has been made or shall i make a motion with the amendment have you spoken with um staff about what you're going to be recommending no i have not

185oh okay i won't make the recommendation i think procedurally it'll happen but it was just uh it's procedurally how it would happen but could you ask the superintendent a question related to what you're hoping to add yes yes thank you and i apologize to my trust my fellow trustees i know that that is our protocol uh it was it was just a mathematical thing that as i was reading the wording i said i wrote down to amend the policy uh with seven to 15 speakers because i agreed with the prior in our prior meeting speaker that one minute per speaker doesn't give enough time to our speakers i think that the president will call to extend the time for public comment to 30 minutes and each speaker will be given two minutes if the number

186of speakers exceeds 15 then those speakers will be given time during the agenda item indicating the speaker time continuation so it's just simply to eliminate because i think we have it with seven eight and then beyond eight so or ordinarily our practice has been you know for the president to extend or call for consensus to extend the time and and 10 minutes felt like it was an easy number round number to extend the number to 15 speakers which we you know rarely go over okay so it looks like that that you did actually not ask a question so that probably um would that be acceptable dr churchill okay there you go thank you so uh sure it's really i'm it's taking me a moment because i'm thinking through process as well it's it's really that

187you know the board's it's the board's bylaw and the board's direction and in the end it's the board president who would be implementing and asking so um it can't could we make that modification the answer is yes um i will defer to a board majority whether or not we should make that modification but um generally speaking i'm supportive of what you're describing okay are there any further questions ms jones your hand is up your hand is down okay um now is the time for public comment on this item ms garcia please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item

188we do not have any callers for this item may i have a motion to approve the updated procedures for public participation at board meetings as presented pearson second jones uh trustee pearson made the motion trustee jones seconded the motion any discussion i guess i'll start out by just responding miss jones i would prefer to leave the language as it is because i think that the addition of the president may extend the amount of time covers what it is that um that your intent and that there i believe are probably times where having one minute would be sufficient but that would probably be more the exception than the rule but i would like to have that in place in those times so i would prefer to leave it as is with an emphasis of knowing that

189this board has a history of extending that time to 30 minutes you know depending on the circumstances so that's my discussion and i miss rawlings thank you i was actually going to make a motion to table this item until we have an opportunity to be provided with um enforcement um i guess from my perspective that you know words on a page is um nothing without um actually what you're going to do um and so any enforcement i think is imperative before so i was only impressed that we might hear that tonight that's why i didn't let anybody know that i would vote no but i'll be voting no unless we agree to table it um and i agree with you that um i do believe that we need to be able to respond in the

190moment and i believe this the language allows the president to do that with consent of the board so the board could certainly make the decision to limit time or move speakers to the end those types of things so i agree with you there but without an enforcement aspect to the to the language um i'll be voting now or if we agree to table and ask um staff to bring it back i would be in favor of that thank you um dalen so it turns out i'm going to be pretty much echoing what role uh trustee rawlings just said um i was also going to ask to table it um for the same reason of enforcement um personally i'm high risk so if it's not well enforced and i work in retail and i've seen it

191not well enforced um then it's not something i would be comfortable with and honestly i don't think as a whole we should be um and then i would agree though that um i like the language as it is i think that makes the most sense and gives the most um makes the most sense thank you dalen mr pearson is it possible to have an amendment to the motion that would include um enforcement into the into the motion to some language into that so proceed procedurally you could you you could ask that the motion be amended yes um but but again to be clear staff is not prepared to describe an enforcement mechanism to you this evening um i would just swallow while i have the floor argue that you could approve um the documents as

192they are and and and come back and have the enforcement discussion at a future date ms williams so i have the same concern in terms of the enforcement i wouldn't mind approving this because i agree with it it's just a matter of how we're going to enforce it and then we are you stating dr churchill that the enforcement will come and then we'll be able to vote on that the enforcement um i apologize they have have not had the opportunity to uh put together a plan for that so um it it certainly could be something it could be something that we um come back and talk about do we need to amend it knowing that this will not be enforced not be enacted until there's an enforcement mechanism for the mask or is that implied

193because could i say something sure we cannot this is a moot until we are no until we are meeting in person right and in order for us to meet in person we're going to have a discussion so each month is we have a discussion on the resolution so i would foresee that when we have the discussion next you know each time if we ever do decide not to pass the resolution what we would do is simply i think that have this item on the agenda okay um prior to with it with each right so um yes anyway so um mr pearson your hand is still up you're you're muted sorry um i was thinking of a way to still do the motion but have the mechanism for executing how we're going to enforce the mass

194or enforce any of the any of the safety precautions in there um because i i would favor something to that effect but i'm not sure procedurally how we could do that if we need to table the motion and bring back the motion in february with the idea of uh language giving would that be enough time dr churchill to give staff so so i anticipate and i appreciate trustee williamson's comment i anticipate um uh there will come a day when the board um votes for us to go back in person and um at whatever meeting that is we can have the discussion about enforcement of whatever the public health protocols happen to be that can be an input into part of the discussion and so yes certainly um if uh if later this evening the board

195approves the resolution to remain virtual for the next 30 days then certainly within 30 days staff will have the opportunity to think about and and um and advise the board about the our recommendation to move forward so yes 30 days would be sufficient for us to bring something back trustee williams are on mute that's my attorney mr pearson did that answer your question it did i'll have a follow-up but i wait till i think there's a few other people okay um oh ms rawlings did you have a follow-up to this yes i wanted to see if i could um offer up a potential amendment and i think you stated it at trustee williamson is that that we add that uh this policy will not go into effect until an enforcement mechanism is um passed by

196the board and that would be amenable to you let me ask a question what what when you say an enforcement mechanism could you give an example of what it is that that you would want to be included in that i guess and again i'm looking at this in a broader scope of you know public health orders so let's say right now the public health order is the indoor masking is required and that is there going to be somebody at the door um you know ensuring that people are wearing masks are there going to be if people walk in they have a mask and then they take them off will there be will they be asked to leave you know what will be the steps to enforce that uh those folks wearing masks and again this

197is just the example if there was a different health order how would that be enforced and will employees be doing it we'll be asking for a private security uh company to do it or would we ask the carlsbad police to do it those are all the things that are more specific to the policy dr churchill could you address that yeah you know so so there's two things number one we have a board by law 9323 which describes the board president's ability as the presiding officer to terminate the privilege of addressing the board to remove disruptive individuals and order the room cleared if necessary um so our board bylaw allows for that and and uh describes it um i i think uh having had some introductory discussion with our police chief i think it would be

198prudent for us to get the counsel uh from of both carlsbad police department um and our attorneys before we make any have any consideration of uh enforcement um i i think i'm uncomfortable having the discussion tonight absent clear concrete guidance from legal professionals and our our law enforcement partners we have an outstanding relationship with carlsbad pd i'm confident that they will be willing and able to to provide advice um i am also confident that our attorneys will be able to do the research necessary to to give us good counsel until we have that however i just i can't really speak to the specifics of what was just described rusty rollins thank you and and that's exactly my point is that when you read that policy the president is not going to stand up and do

199the actual removing of someone if necessary right i mean they the president absolutely would be residing over that meeting my concern is is that if we say this is what we're doing without an enforcement mechanism um again i'm not comfortable in okaying a policy unless we know how it's going to actually work in practice so that's so that's my discomfort and so if it goes forward i would be voting no or if it's amended to say that we would not be putting this policy in place or table would be what is where i sit on this issue thank you mr pearson so trustee rawlings uh presented a potential amendment that i would support it i think there's a connection between the motion and the amendment to see that before we before we actually adopt the

200procedure we have to have the execution how it's going to be executed in other words and i i would support that absolutely to do that so i guess my question oh sorry miss uh ms williams i just wanted to quickly say i am i concur with uh trustee rawlings i agree so so i guess my question is i have a quick follow-up yes yes ms jones i i would just like to say that uh exhibit a c and d could proceed forward the only part of the public health directive is is exhibit b so i believe the amended motion would be approval of exhibit a exhibit c and exhibit d is presented and to table exhibit b to a future meeting great minds think alike okay who made the motion you did president williams did

201i really i don't think i did she did you said since you brought the since you brought it forward you would be making a motion and you had a four step i thought i believe that was for the previous agenda item garcia have we had a motion yet i've um recorded that um mr pearson yes made a motion and uh miss jones made the second yes yes mr pearson corrected okay mr pearson would you like to amend your motion uh let me get uh let me get trustee rawlings language again and then i will amend the motion with her her with what she said next mr pearson mr mr pearson could i interrupt you and say if you just a move that you have that we approve items a b and d and hold off

202on c is that one a c and it was actually my second i'll second okay that admitted all right are there is there any further discussion ms garcia please call for a vote student representative dalen rose yes trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes that passed unanimously we now move to item 8.6 resolution number 27 2122 continuing board of trustees authority to hold virtual meetings pursuant to ab361 trustees this is a discussion action item i'll turn it over to dr churchill thank you trustees i'll go again quickly through these slides they're very similar to what you saw a week ago just with some updated data as we've looked at each of the recent meetings this shows cdc levels of community transmission in san diego county showing here

203that we are still in the red or high transmission tier both these slides are updated at the most recent san diego county press briefing those occur on wednesdays i'm sure they've probably updated it already today but since we've been in the meeting i haven't been able to look uh so you can see here um this is the case count in san diego county and rapid increase due to omicron case counts are not the only thing that the county looks at they have 13 triggers you can see the status of those 13 triggers here on this dashboard the city manager's office pulls together this data each week so this is uh most recently um last thursday the active or sometime last week active covered cases in carlsbad uh you can see the increase again mirroring the

204county uh we touched on it in the last item but california does have an indoor mass mandate through february 15th um so we'll take board questions and public comment and then it is staff's recommendation that as long as the indoor mass mandate is in effect uh that the board continued meeting virtually due to the indoor setting of meeting facilities the potential for non-compliance with mass learning requirements and the desire to protect the health of the immunocompromised staff and public most importantly we want to minimize any chance of community transmission at a public meeting that might result in further transmission in the homes of our students and staff further exacerbating our challenges with keeping our doors open keeping our schools open must be the top priority as such we recommend you approve this resolution for the

205next 30 days thank you dr churchill trustees do you have any questions miss jones yes dr churchill just for clarification i was asked the question um passing the resolution doesn't always necessarily mean that you will maintain virtual meetings it's just a procedural maneuver to allow for virtual meetings to happen and as we've passed the resolutions so that's my first question is that true uh it is true that passage of the wrestle approval of the resolution gives you the option to remain in a virtual setting if you do not pass the resolution you do not have the option to remain virtual okay thank you and we've as a follow-up ordinarily we've had that discussion upon passage of the um resolution that we would remain virtual so that we could communicate that is that or yeah it's

206an interesting um statute that requires us to uh every 30 days approve the resolution in order to continue meeting in such a manner um uh so it's made sense for us to look at the data approve the resolution carry it forward until the next public meeting you certainly could approve the resolution and remain silent on whether or not you want to enact the resolution call a special meeting sometime in advance of the next public meeting and then make that determination but that's not staff's recommendation at this time we think it's cleanest and easiest to review every 30 days make a determination and then come back at the next regular meeting to consider again thank you any further questions now is the time for public comment on this agenda item ms garcia please call for public

207comment member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item we do not have any callers for this item may i have a motion to approve resolution number 27 21-22 continuing board of education board of trustees authority to hold virtual meetings pursuant to a b 361 to be in effect for the next 30 days through february 18 so moved rawlings second jones trustee rawlings made the motion trustee jones second in the motion is there any discussion mr pearson i have uh the last time last two times that we have voted on this resolution and voted against it this time i will be voting for it because of

208the carlsbad metrics not the county metrics however i would i would ask my colleagues that at some point we we put a line in the sand and say when these numbers or metrics if for carlsbad or the county reach a certain level or any of these metrics then we will go back to in-person school board meetings thank you mr pearson trustee rawlings um i i will also be uh voting in favor and one of the reasons why um i wanted to have an enforcement mechanism so we are prepared to go back in person um and that we would have that ability um after what mr churchill said or dr churchill said um i actually would like to amend my own uh motion uh to um to have the motion as stated and to have our

209february 16th meeting be conducted virtually is that an order president williamson absolutely who um i believe i seconded so i'll second okay thank you any discussion about that and i thank you uh trustee rollins and maybe dr churchill we can add that as part of future uh if when this comes up again that's a good idea i will be i will be supporting the motion but if i have the support of my fellow board members i would ask that at the february meeting staff present a metric showing the conditions under which they would recommend returning to in-person meetings uh dr churchill i believe you mentioned one already in your narrative when you said that as long as the mask mandate is in effect that you would not be recommending in-person meetings and my guess is

210there may be some other metrics as well uh trustees this is kind of a thumbs inside of the motion so if you are if you are willing to if you would like staff to come back at the february meeting and present some type of a metric that would give us for future videos could you please show your thumbs i see three four five thumbs okay so dr churchill if you i had mentioned that to dr churchill so this is not a surprise to him so you will be able to do that all right um ms garcia i see no further discussion ms garcia please call for a vote student representative dalen rose she posted a quick note to all of us to say that she had a final and she apologized but she wanted to

211get some sleep so i i graciously let her go poor thing okay um trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes that passes unanimously we'll now move to items eight point seven coup to reope initial reopeners uh trustees this is a discussion action item mr grove the current negotiated agreement with the carlsbad unified teachers association allows for automatic reopeners for salary and benefits plus two additional articles and cuda has indicated that in addition to article 12 compensation and article 14 fringe benefits they intend to reopen article 7 workday and article 18 class size this would be the time that the board would invite public comment and then direct staff to commence bargaining um now is the time let's see first of all trustees do you have any questions

212see none now is the time for public comment on this agenda item ms garcia please call for public oh sorry mr pearson thank you um mr grow um so do we give you parameters after this or how does what's the process yes as as with each time we're at the bargaining table the board provides parameters to your lead negotiator me in closed session and we would continue to have that conversation in our subsequent board meetings okay thank you ms garcia please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak to this item and we do not have any colors for this item may

213i have a motion to receive cuda's initial reopeners so moved rawlings second williams trustee rawlings made the motion trustee williams seconded the motion any discussion ms garcia please call for a vote trustee jones yes trustee williams yes trustee rawlings yes trustee pearson yes trustee williamson yes that passes unanimously part nine government governance team reports and requests are there any governance team reports ms jones thank you president lansin uh really quickly team i just wanted to tell you that today i attended the school services of california governor's budget workshop with mr dill and miss selazar from our fiscal services team all of us wearing n95 masks and socially distanced it was a very slim crowd today i'd like to request that mr dill include school services california's digital presentation to be shared with all of you

214as you know this presentation kicks off the start of the state's budget cycle the governor will come back with his may revise and then the legislature is required to have a balanced budget submitted for the governor's signature by the end of june i would say that overall the budget is very favorable you know if all things remain as is um there were a few things uh they they had one slide in particular it was interesting um of the budget is back to categoricals and 40 in local control so we've definitely the pendulum has swung again so that was disappointing to see and then there was no um pension relief but there was a sizable cola so overall i would say you know they're definitely hearing our concerns i think we do have some legislative footwork

215to do to make sure that some of the concerns we have with some of the new programs that are coming up like tk and the facility needs and staffing et cetera will definitely need to be communicated so i encourage you all to look through that presentation thank you thank you since that was um a request as well as a presentation me i have thumbs for board members to to direct mr dill to provide a copy of the school services report that's unanimous any other governance team reports any governance requests see none um it is see it is 9 29 and this meeting is now adjourned our next regular meeting will be virtual on february 16 2022 at 6 pm the
