015that I am but one element of a policymaking body as such I have no Authority outside the official meetings dependent in part of on my ability to work with my fellow board members in a Spirit of Harmony and cooperation despite differences of opinion that may arise eyes I further recognize that administration of the educational program and the conduct of school business is the responsibility of the superintendent of schools and his or her staff a sense of loyalty to Associates and respect for group decisions cooperatively reached will therefore be my fifth consideration in my actions as a i acknowledge that I am a separate individual my feelings and Views are unique to me based on my own personal experiences like all other individuals I have something to contribute to the sum of society unlike most individuals

018what you may not realize people now associate School boards as one of the same as teachers unions there's no daylight between you so when Becky Pringle president of the National Education Association the largest professional labor union in the United States with 3 million members most people automatically presume you approve of her actions and tactics including Becky Pringle pledging $56,000 towards investigating parents Pringle claims to be the voice of Education in America this does not sound like America to me but M Stalin and Hitler would all be on board Becky Pringle promotes the Nea racial Injustice resource guide to deepen our understanding of racial Injustice and education a handbook for CR teacher training seems all teachers are supposed to do now in the classroom is sh social injustice theories down the throat of our students the
019only subject they need to learn in a John Henri article October 3rdd National Schoolboard Association letter says parents are angry about two issues math mandates and critical race Theory let's focus for a moment on critical race theory part of the problem here is that school boards administrators and many teachers are chronically dishonest about what is going on in the schools their first line of defense is to die deny that CRT plays any part in K12 education is just an obscure Doctrine found in law schools really the leaders of the National School Board Association cannot possibly be unaware of the fact that its annual meeting this year the National Education Association the union that largely controls K12 education us pleds its undying fty to critical race Theory it adopted new business item 39 which encourag teachers
020to instill the principles of critical race theory in their students even if doing so is illegal in their state item 39 the NAA will with guidance on implementation from the Nea president and chairs of the ethnic minority Affairs caucuses share and publicize through existing channels information already available on critical race Theory what it is and what is not have a team of staffers for members who want to learn more and fight back against anti-crt rhetorics and share information with what other Nea members as well as their Community now my statement No More denying no more pretending carlb Unified School District is teaching and promoting critical race Theory and every time you say that it is not true you are lying including the seal materials generated by Dr Dorothy keep in mind during Mal's cultural revolution
021Mal's teachings brain Warth children in the schools to the point children actually killed teachers and their parents you're on a very dangerous path and you are All To Blame no matter what your resolution you quoted before said thank you uh the board will now recess to closed session e for it's 6: pm and the board is Con reconvening from cled session in closed session the board voted unanimously to reject claim number 632 for viewers who may have just joined us at our annual organizational meeting that was held an open session at 5:00 pm I was elected board president I'm Alisa Williamson Mr Pearson board vice president and Miss Rawlings clerk we ex also expressed our appreciation to outgoing president trusty Jones for her leadership during the past 12 months we now move to item 6.1
022census 2020 and trustee area redist redistricting due to the time constraints of our demographer we've organized our agenda this evening to hear his presentation as close to 6 PM as possible trustees thank you for your willingness to do things a little bit differently this evening Dr Churchill thank you trusty Williamson uh as you're aware every 10 years school boards and other local agencies are required to revisit their um trustee area B boundaries to comply with any changes that may have occurred in the most recent census uh we engage in a contract with Cooperative strategies uh a demographers firm to do that work for us uh Mr Josh Chisum is here with us this evening uh to give us a short presentation about um the impact to changes from the 2010 census to the 2020 census
023and then talk through next steps Mr Chisum I see you there and I will turn it over to you sir okay good even evening uh and thank you board for having me this evening and and thank you again for accommodating uh my schedule this evening uh as you can imagine the uh the trustee work is uh has kind of been compressed uh in December with the districts uh with the holidays and so we're thankful to be here uh and thankful for the uh support and so we'll Jump Right In as uh uh Dr Churchill mentioned uh we did take a look at the 2020 Census Data against your current trustee areas uh this is a practice that occurs every 10 years when the Census Data comes out uh and uh particularly after District's transition from
024at large voting to by trusty areas uh eventually uh we believe most most districts will be there uh in carlbad here you've you've already made transition so this practice is to ensure uh that we have equal population amongst all trustee areas uh uh there's a very there's a there's a large difference between redistricting uh here which is balancing the population and creating trusty areas from with a blank canvas uh like was done previously but uh I'll walk through this presentation and then if we have any questions I'm happy to answer those and so see here get my laser pointer on so yeah it was in September that the California Department of Finance did validate the US Census Data uh there were delays and so unfortunately there hasn't been any extension on when these this process
025has to be completed uh so we're we're still held to the final deadline in that respect U but you'll notice that there was almost a 10% growth uh in your District over the last 10 years just over 7,000 people uh you can see here in the table the 2020 population amongst all five truste areas uh totaling 71,000 uh here in 2020 that's grown to 78,500 uh you can see in this column where it's gone up where it's gone down uh and clearly you have an area that has grown significantly in trusty area 2 at 32% growth uh in trusty area one uh that's actually shrunk a little bit just just under 800 people shrunk and so what happens here over a 10e period like this uh when we transition uh to by trusty voting areas
026we have an equal balanc population based on the 10% or I'm sorry uh based on the 2010 Census Data uh and you can see here how this population amongst all the trusty areas was fairly close uh which is good uh when you transitioned uh and then when you start to look at what's happened in the last 10 years we get this dispersement um of population some areas grow some areas shrink and the intent of this practice is to redis redistribute so we have as equal a number of occupants in each trustee area as possible uh the the intent behind that is to ensure that there is um this one person kind of one vote mentality and so every person has an equal uh impact in their vote as long as there's there's an equal distribution
027amongst population one could argue in trusty area 2 that their vote is not as powerful as as uh someone who lives in trusty Area 1 right now for example uh because their vote is somewhat more diluted than the trusty area one votes so that's the practice uh what what we're really looking at here is the overall variance and that's uh that is based on total population it's not based on the voting age population or the voters even though we do use that information to inform this process uh but you'll notice that uh in this situ situation we take the total population and we divide that by the total number of trustees and that's our Target population that we're shooting for and so if we're below that Target population we have a negative variance from the
028Target and if we're AB above the target population we have a positive variance we're so far above the the target we're so far below and the calculation that's utilized to determine the total variance is by taking the most populated area and adding that on top of the least populated area to get the range above and below the Target and so in this scenario as you you probably could guess based on how the population changed in the last 10 years trusty area uh two and trusty area one are the driving factors here so if you add these two numbers up you'll get the 36.4% variance now uh what the election code uh and the Californian Voting Rights Act tells us is that we can have as much as 10% variance uh uh and still be in
029compliance with the law here in this uh scenario we're at 36.4% so we are above uh where we need to be and we will need to embark on the process of adjusting the boundaries uh in certain areas to rebalance the population amongst your trusty areas um you'll also notice here that truste area four is at 8% even if we got the rest of them to zero we would still be at 8% um and so this area you know several of these areas are going to need to be adjusted for us to get back into compliance and so here's a slide that shows your District the exterior boundaries of your District in the black lines here uh this this tap Tel to the right shows the total population and the age 18 and over population uh
030based on the 2020 cnis data and it's broken down by ethnicity and some things to point out is that uh the the Hispanic Latino population is considered a protected class uh and that protected class makes up 18.3% of your population uh the uh and the white class makes up 66.1% of your population so the majority after that is the Asian population and then two or more races below that so again we use age 18 and over as a uh inference point but this is not what's driving the process the total population is really driving uh the process of balancing from a number standpoint balancing the populations you'll notice that these age 18 and older and total population uh will in General carry fairly similar percentages from a proportion standpoint across your District this slide here
031shows the Hispanic Latino population on a density map and so the more uh hispan Latino occupants per uh per per census block uh the darker the red and so this this again is an inference point doesn't necessarily mean that there's the most people in these areas for example this dark red area down here there could be uh 10 people out of 10 people in this whole area are Hispanic Latino but in this dark area there could be you know 200 Hispanic Latinos so this is more about density and not necessarily about quantity but it's it's a good uh heat map so to speak to help us understand where the Hispanic Latino population in general lives and so you'll notice here at this table to the right is the cvap uh this is the citizen voting
032age population and so uh these are citizens these are voters and this is a estimate that's based on a What's called the American Community survey this is a survey that goes out every year uh and these estimates are on are based on a fiveyear rolling survey and so we don't have the 2020 data yet because that survey results haven't been released uh but this is another inference point for us to utilize to understand where are uh the his what percentage of the Hispanic Latino voters are in uh Carlsbad UniFi so here's a map of your current trustee areas uh this uh should be uh shouldn't be new information but we provide this as a starting point for you to understand for the community to understand if they haven't seen these maps that this is this
033is the breakdown of the five trustee areas uh and the boundaries of the district are the black line so this is really where uh the meat of this presentation lives in this slide here you'll notice again that the total variance is 36.4% as I mentioned earlier if we take the total population and divide that by five we'll get our ideal trusty area of population so 15684 that's our Target that's what we're shooting for uh for all five trusty areas uh and we know that and the law allows that we cannot get exactly 15,683 in all five trustey areas so that's why we're allowed to have that 10% variance U uh 10% variance again against the the Target that we're looking for so on this slide we do show that trusty area one and two are
034the driving factors uh here in the process and and these areas in particular uh will need to focus on when considering making adjustments to the boundaries uh fortunately uh these two areas do share a boundary and so that makes this process a little bit easier to look for a place where uh we can make trusty area one grow gr uh and trusty area 2 shrink geographically and as a result total population will go up trusty area one total population will go down and trusty area two okay you'll also notice that we do uh look at the Hispanic Latino uh voting uh voting age population here in each trusty area uh in general uh depending on the demographics of the district if there's potential for a majority minority uh uh scenario here that's something that would
035be considered uh specifically when we're transitioning uh from a blank canvas are there any areas that we can consider uh to draw Maps where we can provide Hispanic Latino population since they are the largest population uh protected class population in your district is there a opportunity here to draw boundaries where we could provide a a majority minority Trust the area or if not uh would we be able to provide a high percentage uh and so uh that's that's certainly far from uh what we see here uh you know if we're in the 40s then uh that's that's where it starts to get to a point where okay we may be able to make some adjustments to get that uh up above 50% uh I'm not saying that's it's not possible here uh but uh from
036a demographer standpoint this is a this would be a challenge to to create a majority minority District okay uh and so here are is a slide that we actually use when we help districts transition from atlarge voting to by trustee area voting uh but we still need to keep these considerations in mind as we make adjustments to the boundaries and as the demographics change over the 10 years from the previous census so in the top left corner um this one we've spoken about we need to have nearly equal number of inhabitants in all trusty areas in order to comply with the federal Voting Rights Act this is uh to ensure that we do not impair uh a protected class's ability to have a collective vote uh and so for an example of that would be
037we have an area in the district that is a high Hispanic Latino percentage and we draw a boundary right through the center of it to dilute that vote into uh a smaller percentage and then there is no Collective vote uh so that's the federal Voting Rights Act and that that also falls in line with the California Voting Rights Act okay uh compac and contiguous is pretty straightforward communities of Interest are oftentimes things that um the district the board the community will have to inform the demographer about uh oftentimes we don't know just looking from the streets and the roads whether or not there's a a Comm that shouldn't be split up uh if if possible man-made and natural geographic figures are features are always something that are helpful oftentimes these promote a lot of these
038different um checkboxes here uh we do try to respect incumbency uh meaning all the board members who are living in their trusty areas um if possible that we can draw the boundaries without um without opposing the will of the voters who voted these folks in now it is important to note that these changes do not impact any of the board members terms uh if for example uh one of the trustees currently lives right on the boundary and that boundary has to shift uh One Direction or the other and all of a sudden that trustee does no longer live in that area uh for one we would try not to do that to respect that incumbency but if it has to be done it doesn't Force anyone out of their current seat uh and finally other
039local considerations especially for school districts are attendance boundaries I'm sure this was something that you were considering as uh you transitioned into by trusty voting areas and create these voting areas uh but it's important to note that as the populations change and we're forced uh by law to make these adjustments to the truste areas we're not forced to change the attendance boundaries so oftentimes what we find is those attendance boundaries and the trusty areas uh do do tend to migrate away from each other as the populations change over time okay so here's the timeline that we're looking at to get through this process Here We Are Tonight uh doing the evaluation on your existing voting areas and as I mentioned you you are out of compliance and so what we'll do is we'll look for
040feedback from the board from the community tonight uh if there is any on on ways that we May uh that we may want to make these adjustments to consider uh for getting back into compliance and uh after we do that we will create some scenarios uh we oftentimes make two to three scenarios and we'll provide those to uh the superintendent in early January those will be posted on the website for the community to have an opportunity to review them and prepare any input or feedback back in the board meeting in January when we do come uh to the board in January we'll do a quick walk through and overview of the scenarios that we've created that are back into compliance with uh with the California Voting Rights Act and the election code and if if
041those scenarios work uh the board can consider keeping those uh and walking into the next meeting with a vote uh if there is feedback well hey we'd like to make this change we might like to make that change to this scenario we'll we'll take that feedback we'll go back to the drawing board make the adjustments that uh that have been requested and provide those adjustments to uh the superintendent before the uh February meeting here and then we would look for adoption at the February 16th meeting uh there there is a deadline uh with the county to finish this process by February 2 8 and that deadline is set in order for us to uh provide the county with an updated digital map or shape file of the map so the county can ensure that when
042the ballots go out in November during the election that they will have the right ballots to the right people with the correct trustees on those ballots uh to to ensure that the new map is uh is becoming effective okay with that I'll I'll open it up uh thank you very much Mr chis could you remind us what time you're having to hop off this meeting uh I have until 6:30 6:40 okay uh board members if you have questions that have not been answered uh go ahead and uh raise your hand Mr Pearson and then after Mr Pearson Miss Rawlings and just please ask one question and make it as distinct as you can thank you president Williamson Mr Chisum uh just very quickly on uh other districts that have had to be or are out
043of compliance are they holding public hearings what are they doing in terms of public input although public hearings are not uh required we do encourage public hearings to be held uh certainly at the next board meeting uh it gives the public an opportunity formally to provide input when we go to the county after the board has selected a map to move forward we will provide the county with a a memo that describes the process and most counties are looking for in that memo the board did provide the community an opportunity in a formal public hearing so I I do recommend that at the next meeting uh and if we need uh the the last meeting I would recommend it there as well miss Rollins and then miss jnes thank you um I had asked in
044um our questions I didn't get a clear answer on it um is it possible to get a map that has the overlay information on it that has the communities of Interest populations and major streets on the same map rather than having to go back and forth amongst multiple Maps thank you trusty Rawlings I I did get that information this afternoon uh and we I do believe we can overlay uh those layers those four layers onto one map uh I need to get with my data analyst to confirm that but uh I I I've already forwarded that information to our analyst and uh and I'm hopeful that I can get that information to you before the holiday break if not right when we get back Miss johnes yes um Mr Chism I was curious uh your
045focus is obviously in trustee area one and two but were there other trustee areas that you felt that we would have to do tweaking on I do uh certainly truste area for needs to be rebalanced that's if I see anything over 5% uh that's kind of a trigger point to say okay we need to try and get this back down below % ideally we don't have any above five and any below five so we can get less than you know when we add those two up we're not going to be above 10 so certainly trust area 4 um I wouldn't be opposed to seeing trust area three and five uh adjusted slightly as well to to try and rebalance all all of five of them thank you the the question that I have is at
046first glance it my understanding is is that you are not under the impression that we would be able to draw the lines in such a way that a community of Interest would become the majority is that correct for the Hispanic Latino Community correct I think that it would be very difficult I I don't know without having our analysts actually go through and they'll select uh census blocks but we did I did talk to my analyst a week or so ago about that they went through and they actually highlighted all the census blocks that had over 50% of the population within them representing the Hispanic Latino population and uh the areas were quite fairly spread out amongst all trusty areas there was one uh Zone up kind of up in the this uh trustey area one
047that had you know four or five but off the cuff I would say it would be quite difficult uh to get a majority minority in any of your trusty areas okay thank you Mr Pearson you have another question I did and in um in our our last as we were drawing uh as we were drawing maps for districts we wanted to have multiple schools in each district is that going to be possible in the rebalancing uh we're happy to post uh to get a list of your schools and addresses off your website and then drop those pins onto the maps we can also provide a simple table that shows in this trustee area you have X number of schools in this trustee area you have X number of schools uh and and we'll do that
048when we bring the maps back Mr Rollins yes did you um uh have the opportunity to take a look at some of the other maps that were considered and where the major population growths have occurred um as far as new developments in the different trustee areas well I have studied the green map uh the orange map and I believe it was yellow map uh that was a that was a PDF file I was provided by superintendent Churchill uh uh we did not redraw the boundaries for all those maps to and then run the calculations traditionally we take the map that was adopted uh and then we drop that into our software draw the boundaries the way that it were drawn the last time and then run the numbers um I did review those those Maps
049I looked at those Maps against the Hispanic Latino populations as that was one of the questions we were asked uh is is would that provide a majority minority or an increase uh in any of the trustee areas I didn't feel like it would create a majority minority but I don't know exactly how the the voting age population with those five trustey areas would change if we were to consider say the orange map uh I don't I don't know without running the numbers my question is about new developments as far as we've had two major new developments and I was wondering if those were taken into consideration when you're looking at the other Maps um no I didn't look at that so so my assumption is is that the new development was in trusty area too
050with this with with this growth and I don't know how the other two maps were drawn I don't know where those developments occurred so so no ma'am I did not look at those thank you I don't see any other questions um and now is the time for public comment on this agenda item Miss Garcia please call for public comment if any member of the public wishes to provide public comment on agenda item 6.1 census 2020 and trusty area redistricting now is the time to do so if if you are on the line press star n to indicate you wish to speak on this item there are zero callers that have indicated that they'd like to speed speak on this item okay thank you trustees this is now the time to discuss the redistricting for a
051purpose of the direction that we collectively will give to Mr Chisum um slide seven it illustrates the overall consideration in establishing voting are is as uh Mr P as trusty Pearson mentioned in the last time we went through this one additional consideration that the board directed was to have each Elementary and each Middle School be represented by at least two board members uh trustees if you have come to a conclusion as far as what you are going the direction that you would be hoping to provide tonight um as you begin your remarks would you say indicate what that um direction is and then you can give an explanation and I'll begin so that I can so you can understand what I'm saying um uh my uh I would support using the green map as a
052starting point in other words leaving staying with the map that we have and simply um making the moving the various communities or the lines following the considerations on line seven which is following man-made and natural geographic features as much as possible moving you entire communities as much as possible as you rebalance the um as you rebalance the voting area once we have each expressed an opinion I'll ask for thumbs and hopefully we'll be able to um do this quickly enough that uh Mr Chism will have the won't have to look at the uh replay of of this who would like to share uh their thoughts next um Miss Rollings and then Mr Pearson thank you um uh one of the reasons I asked about the developments is what I did notice is both of the
053large developments are um in uh trusty Williamson's area and that has um uh and I'm not sure that we took that into consideration when we drew these Maps initially secondly um I do know that um when we drew these Maps uh they are not along major uh roads um there are literally in my backyard area is not part of that goes beyond my fence is not part of my trustee area and therefore I do believe that um uh I do recognize that that working off of um working off of the green map is important but if we do that I think if we were to split up the two neighborhoods that um the two major develop velopments um and or go with a major roads I think we would end up closer to the orange
054map so that's where I would like to see a combination of the orange map and the um uh and the green map to follow uh major roads such as car's bed Village Drive El Camino Real tamarak some of the major roads to help divide up uh the trustee areas um as well as um I like to see the plaza area which is the the Oceanside area and the Cory Creek area to to stay in the same trustee area um some of these areas have been split up into three different trustee areas in major um within major neighborhoods so those are the areas I'd like to see us look at at least get a consideration from the demographer okay Mr Pearson I support uh president Williamson's uh initial proposal to start with the green map and
055see if the balancing of population is going to be um taking consideration those I think there's seven points along with having an elementary and middle school in multiple trustee areas so I would I would support beginning that uh beginning the process that way okay uh Miss Williams thank you I'm I'm I'm in agreement with uh truste Rollings in terms of doing a combination of the green map with the orange map one is but make sure U keeping the Hispanic Latin community population together and then unifying the query Creek area and Plaza on the North End and then separating the other there's been two new developments separating those two new developments a quar creek and the Robertson Ranch which would kind of the southide would be similar to the orange map I'm sorry Miss Williams would
056would you mind repeating the last two uh neighborhoods sure the the two larger developments were C query Creek and Plaza area and then the Robertson Ranch the new development keeping those areas in the same trusty area is that what the request was separating them that's why there is so much that's why there was so much the increase of population got it thank you so um thank you for all of your comments board members it helps me decide I think uh I'm somewhere I'm more in line with trustey Williamson's request but I recognize I think more as a priority for me um was to stay as true to the map that was approved by all the public um hearings that we had uh when this was approved because it wasn't fully 10 years ago it was
057in the middle of that so I understand that there were significant developments but I believe that that was cons considered um when we looked at that um at the other two maps when we talked about it the priority was making sure that there were two trustee or two two multiple trustees representing various parts of the school district so that there wasn't a laser focus on you know my district my school my you know whatever I think keeping that unified overall um prioritization but I I I am interested in the in the impact of the two large developments understand it splitting them can be confusing to those neighborhoods um but I I would uh based on what Mr Chism has presented there is um an acknowledgement of the man-made and and geographic features so making those
058adjustments be minor so it's not wholesale changes is my preference okay thank you oh um uh Miss Rollins and Miss Williams you both have your hands up I don't okay um so miss uh Rollins go ahead thank you um I just I did want to point out that um in looking at my uh truste area is um it goes from the very top of the district um to the very um uh the furthest end of the boundaries and mine's the only District that does that and so that was one of the interests um that I was looking at is that um is uh the geographic area that mine covers differently than others as well as um again keeping the neighborhoods together um when you look at um the difference between the plaza area and South
059carlbad um those areas are very different and and don't have a lot of community of interest um in that uh within that map that section thank you um I we have a couple more minutes I would like to um but I think I heard was perhaps three uh thumbs three board members supporting starting or maybe four starting with the existing map um so if we could just work like one item at a time if you support starting with the existing map and then tweaking it to move populations and then we'll get a little bit more specific after that so if you if you support starting with the existing map and then tweaking it please show your indicate that by your thumb okay I see three thumbs up I don't see Miss Rollins or Miss Williams
060did you show a thumb so miss brollins you're a no and Miss Williams are you a no okay all right so we have three thumbs for starting with the with the existing map and then I guess the next item would be now that we have the the board majority is saying to start with the existing map um is there interest in by the board majority in using [Music] um let's see what would be the next question um Mr tism what would be what is another question that you maybe or a direction you were hearing that you would like to hear if we have a board majority in supporting that yeah so some of the other things that I heard was was to split up the query Creek and Robertson Ranch communities okay let's ask that
061um if if you feel that it's important to se to separate those two the two large new developments Corey Creek and Robertson Ranch um to remove those from I guess either remove them from District Two or to at least remove one of them to give that direction uh do a thumbs up mine is down I see two up Miss Jones and Mr Pearson you did not get the thumbs up on that no okay so so that does not uh that direction does not have a majority support what other items were there did that did you hear that you have would have questions on Mr tism uh so uh I believe it was mentioned to unify unify the plaza area is that fair a fair I believe it was to put was that to put the
062plaza in with like the the orange map to have it going all the way to the coast M was Plaza and Cory Creek since Cory Creek didn't exist when we Dre this map okay yeah it was on the books but it had not it was not populated yet okay so so that would um necessitate moving cutting out either Quarry Creek and scooting it over to uh District are you District Five Miss Rollins that's correct yes okay so it would carve out part of Quarry Creek it would necessitate doing that or having that be as one of the options if if board members if you support having that be one of the options of balancing the population as they um draw those up please show a thumbs up so I have a quick question on that
063item I guess my concern with setting this as a priority is already five is overpopulated from four and three based on the figures and so adding more would wouldn't that exacerbate the variance that's true if if trusty area five is going to do anything it needs to shrink geographically right okay so I can't support growing something that needs to shrink okay and obviously or if the recommendation comes to shift some of the bottom of five into four with a natural or you know geographic feature man-made feature and adherence you know again legal making the changes that are legal and that we're meeting the requirements and and the original intent so so if oh Mr Pearson you're you're muted just a quick question on process president Williamson coming from you yes is is your tent uh
064following Mr chism's priorities that we have to balance area one trustee area one and how we get there was that in the first vote on starting with the green map absolutely this using some of these developments absolutely okay I just want I want it to be clear thank you yes so if you board members if you want to move Quarry Quarry Creek over to District Five please show your thumb thumb up trusty Williamson that wasn't the request that I had made though okay so sorry so say it again um the and and again it could be in my area it could be in two it could be however the the population Falls what I was saying is keeping the plaza area which is Oceanside the areas of our district that include Oceanside and Corey Creek
065as a community of Interest okay all right if those of you who would support um making the change so that that would happen please please uh show your Thumb Thumbs Up I see one two three okay so if you that could I see four so Mr Chisum if you could have that be part of your uh one of your um the maps that you'll be presenting to us were there any other questions Mr Chisum that you heard I think I think there was unanimous support for an elementary school in a middle school in each trustee area uh and preferably where they would be shared by two Trust trust so there's no uh single single focus on those yes please anything else it's 6:41 so thank you so much for hanging in there with us thank
066you board members for allowing me to kind of Rush us along but I really wanted him to hear the discussion um very good we'll we'll get some scenarios put together we'll get them back to uh Dr Churchill and we will look forward to seeing you guys in in January have have some uh great holidays thank you very much thank you we will now move to item 7.1 report by our student representative Mia Humphrey make sure you unmute yourself yeah thank you yes of course okay so I have a lot to update you guys on so we're gonna start with sage Sage Creek students are in the third week of the second trimester of the year the winter formal took place at the flower fields on December 4th the venue was great and the students had

076find a way to live with it the good news is we know natural immunity is durable and effective we know we have effective and inexpensive medicines to fight covid like Ivermectin hydroxy chlorine asthma steroids and inhalers there's also good news regarding the Omicron variant Dr Angelique cooty who first identified Omicron reports that patients experience extremely mild symptoms 18 18 months into the pandemic it is clear that masking children is an ineffective policy not supported by research or data children are at low risk from covid and asymptomatic children rarely spread covid at all we know that maske wearing has many negative effects including damage children's speech development and that wearing masks throughout the day can hinder language and socio emotional development particularly for younger children let's support mask choice and make 2022 a post-pandemic year even
077the Democrat Governor of Colorado announced this week quote the covid-19 emergency is over now CRT while originally an academic discipline built on identity-based Marxism it has become the default ideology in our public institutions we know CRT views everything through the prism of race and identities and is therefore racist and divisive we know the Marxist roots of CRT manifests in anti-American anti-christian anti-family indoctrination this is not what we want taught to our children we want all our children to be welcomed and loved for who they are regardless of race or identity today we celebrate the anniversary of the Bill of Rights while not one of the original 10 the 14th Amendment affords all US citizens due process and equal protection of the laws we celebrate the Declaration of Independence which states all men are created equal
078endowed by their creator with certain unalienable rights let's teach our children this great lesson let's go back to the basics in 202 to teach Reading Writing Math Science and Civics let's welcome 22 22 by leaving critical race Theory it's many euphemisms thank you our next caller is 7396 please press star six to unmute yes hello this is Tamara Dixon I live in carlbad and I uh know that you are working with Dr dorsy for um a three-year cultural project I would highly suggest that you watch his video if you have not done that he lied to truste Williamson when he stated he would not train in the belief of CRT when in fact he is that's why I want you to watch his video a thisa parent showed me a couple of nights ago a
079test his eight-year-old daughter took she had she had to Define Jim Crow laws this is an 8-year-old child this is a pure demonstration on how radical some teachers have become is this what dorsy went meant when he uh said that he wanted CRT oh I don't think so he said that it would not be uh taught that he's lying why did Dr dorsy single out transgenders when he referenced himself as his power is to diminished around white colleagues is this another ploy to sneak help studies into the CRT Dei curriculum for health this is what they sometimes will teach and I have had Hands-On um experience with these books and with these uh other things that uh they do um they do teach in health are you familiar with the books called lawn booy and
080gender queer I'm not even going to start reading what they say in that have you ever heard of blood playle dental dam or vaginal fisting what about defining sex as oral anal or vaginal with illustrations to show you how this is what our kids are being shown in health this is what's being shown under CRT Dei do you really think this kind of crap is good for our kids and our children would you want your children taught this this is it period I'm done thank you our next caller is 1681 please press star six to unmute yes this is Katie Taylor again I could only dream and wish that equal School protection under the law would somehow apply to the children in the Carl's bed Unified School District I was I wish some way Thomas
081Jefferson George Washington Our Heroes of the past could come down and save our children from the damage being done by the Carl's Bad school board and superintendent Church Hill these children deserve protection but there's nobody there protecting them they're not protecting them from fear-mongering by making them wear masks and you think we need social emotional learning it's because of you and I hope all of you take some time to realize what a disastrous failure you have been as a school board I hope you take time to realize how angry people are at the indoctrination and the brainwashing happening to our children and I hope you realize the last two speakers had a lot to tell you if you were even listening please Carl's bed wake up protect the children in the Carl's bed Unified School
082District protect them from this school board and I'm requesting right now immediately every member of the school board resign trusty Williamson that was our final caller thank you we now move to agenda item 8.1 the consent calendar all matters listed on the consent calendar are considered by the board to be routine and will be enacted by the board in one motion there will be no discussion on these items prior to the time the board votes on the motion unless members of the board staff or public request specific items to be discussed and or removed from the consent calendar now is the time for public comment on this agenda item Miss Garcia please call for public comment if any member of the public wishes to provide public comment on the consent calender now is the time
083to do so if you are on the line press star 9 to indicate you wish to speak on this item we have uh zero callers that have indicated they want to speak on this item thank you trustee Williams has asked that item 8.3 be pulled trustees are there any additional items to be pulled may I have a motion to approve the consent calendar with the exception of item 8.3 so moved Jones second Rawlings truste Jones made the motion trusty Rawlings SEC seconded the motion Miss Garcia please call for a vote trusty Jones yes trusty Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes that passed unanimously trusty Williams can you address item 8.3 that you requested be pulled yes thank you I pulled item 8.3 since I'll will be abstaining from voting on
084this item city of Carlsbad is listed on the PO register um my company works for the city of carlbad while no conflict of while no material conflict of interest exist out of abundance of caution I want to avoid the perception of a conflict of interest thank you would someone please U make a motion that we approve item 8.3 so move Jones second Pearson thank you truste Jones made the motion truste Pearson seconded the motion Miss Garcia please call for a vote trusty Jones yes trusty Williams abstain trusty Rollings yes trusty Pearson yes trusty Williamson uh yes that item passes for yes one abstain we now move to item 9 .1 resolution number 22122 this is a discussion action item Mr Dill thank you and good evening president Williamson uh this item the board will be
085considering twice tonight once on behalf of the district and once on behalf of the educational facilities corporation uh we previously provided information had a quite a lengthy discussion back in September uh with the board to support the issuance of certificates of participation so that we can at additional Capital proceeds to use in our longrange facilities master plan projects additional uh cost pressures have Arisen since 2018 that justify that need and the community facilities districts generate a fixed and predictable source of special tax revenue that we would be borrowing against to discharge that debt so pulling those dollars forward that meets the needs our community has now on the current development enrollment which is why those uh why those were charged in the first first place um the district has used that structure before uh of
086certificates of participation most recently in 2016 uh that's backed by Community facilities District number three and the structure of this deal is that the district grants a leasehold interest in a property to the corporation the district then makes lease payments to the corporation and we sell that interest uh in that Revenue to investors but the ownership and the title of the property remains with the district all times and then the lease payment Once the lease payments are are finished um uh that terminates the debt actually it's the other way around once we once we finish the debt the lease is terminated um the documents before you this evening are necessary to affect this transaction um there may be blanks in some of those documents at this point but that's typical for uh uh approval of
087issuance of debt we we will be working on these documents uh right up until the sale and what you are approving tonight is the form of the documents which would not significantly change uh at this point we're expecting to issue an estimated $25.1 million in principal which would be paid over 30 years the resolution authorizes issuance of the principal up to 31 million but that's really Safe Harbor language this gives us the opportunity to evaluate interest rates and adjust the principal amount right up to the date of the sale while we stay within the boundaries of a affordability uh the proposed structure of the debt also takes into account the current special tax obligations of existing properties within the cfds and also the previous debt uh that is backed by that Revenue the total debt
088service for the previous and the upcoming certificates of participation will be below the tax revenue that's generated so that there's sufficient coverage without jeopardizing any other funds at the district so while I know the documents are lengthy I know the board is familiar with this type of transaction you've had an opportunity to review and ask questions prior to the meeting uh but I'm happy to answer any additional questions that you might have we also have representatives from our financing team here tonight I would also like to uh compliment Mr kocha uh for the most plain English explanation of all the documents I've ever seen uh which is attached in the executive summary uh to this item so once we uh entertain any questions and discussion of the board uh our request would be that the
089Board of Trustees approve resolution 22- 2122 authorizing the execution and delivery of the documents relating to the sale and delivery of the carlbad Unified School District certificates of participation and authorizing and directing certain related actions thank you Mr D are there any questions from the trustees uh I just have one question Mr cardi things have have changed a little bit in the market since we last chatted and the FED indicates that things are maybe a little bit different as far as uh in in um interest rate increases next year do you see anything different um as a res as far as this goes related to what's happened in the market and in the economy sure um Miss Williamson that's that's a very good question I think um and I was looking at that I think
090compared to where we were when we made our presentation I think back in September interest rates are actually today probably a touch lower um on the one hand we do have the concern about inflationary pressures and that was addressed today by the Federal Reserve but counteracting that you know we have nervousness about this latest covid variant and you know the fact that that may suppress the economy so today the market was really unchanged Ed as a result of the Federal Reserve announcement that they may look to raise rates two or three times in 2022 I think we may benefit from our timing hopefully being ready to access the market maybe in February of 2022 so I think we're pretty much where we thought we were going to be in September maybe actually a touch lower
091despite the inflation pressures I think the concern about this latest covid variant and what that might mean for the economy is probably worked a little bit in our favor from an interest rate perspective thank you Mr pieron you have your hand up do thank you president Williamson uh Mr D uh those great explanations and common language that Mr Cas NOA uh did are those going to be posted on our website well they're posted with this agenda which is linked from from our website so anyone who's interested would be able to see that okay seeing no further questions uh now is the time for public comment on this agenda item Miss Garcia please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time
092to do so if you are on the line press star n to indicate you wish to speak on this item we have uh no callers have indicated that they'd like to speak to this item thank you uh may I have a motion to approve resolution number 22- 2122 authorizing the execution and delivery and of documents related to relating to the sale and delivery of Carl bed Unified School District certificates of participation 2022 School financing projects and authorizing and directing certain related actions so moved so moved Rollings or second Pearson either way trusty Rollings made the motion trusty Pearson seconded the motion trustees do you have any comments Miss Garcia please call for a vote okay uh trusty Jones yes trusty Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes that passes unanimously we
093now move to item 9.2 first interim financial report this is a discussion action item Mr Dill thank you very much um I would like to uh present to you the first interim budget report uh this reflects all of the changes uh that have occurred in the budget since the uh tra since the board adopted its budget and the state adopted its budget and all of the subsequent uh trailer bills um there's been a lot of movement uh you unusually so in in this particular year uh and so quite a bit of work has gone into preparation of this budget report and I would like to uh recognize uh relli Salazar who is our new director of fiscal Services uh who um has her camera off but she's here with me here um but miss Salazar
094uh there she is uh waving um she's the one who's responsible for all of this work and has done a fantastic job and uh hit the ground running when she joined our team uh in the summer and so I'd like to thank her for for all of this work um and you'll be seeing certainly a lot more of her in in the future uh this budget uh reflects a uh positive certification which we'll be presenting to the San Diego County Office of Education um but uh the situation we do believe will improve uh over this fiscal year and our Outlook into the future now I I'll talk about those key projection factors that we're looking at for the next year um many of which will not become clear until we get into this into the
095spring um but the takeaway is that we're set up for stability and uh and that's all very good news so I'm going to share my screen now as soon as I get to the right button and walk us through uh the presentation so the themes uh for the first inter room as I mentioned will be recognizing the new uh state revenue uh that has occurred uh we have are have adjusted the beginning balances since the preparation and presentation of the UN audited actuals um which is the first thing that Miss Salazar did when she got here um the other good news is that we narrowed the gap between revenue and expenditure since budget adoption and then as we uh project out into the future you know depending on uh a number of different factors which
096again I'll discuss uh we could be teetering between funding models between Community funding and local control funding uh formula you'll be hearing me talk a lot about that over the course of this year so very high level summary uh looking at at the first column which was budget adoptions middle column where we are now at uh first interim and the difference you can see uh a net increase of of $10 million in Revenue I'll walk you through that uh expenditures have increased by 4 million it is typical that expenditures increase at first inter we see this every year what we don't normally see is an increase in Revenue at this period of time so often it looks a lot worse at first inter room this is a different story because of uh a number of
097one-time Revenue sources um on the bottom when I show the ending balance uh I I did a little trick here and what I did do is I took the uh the new revised beginning balance from un audited actuals and I plugged it in here to show you uh if we had known with 100% certainty when we adopted the budget where we would end un audited actuals what would this have looked like uh Apples to Apples from what we know now versus you know what we were estimating at at adoption um so that shows you what the change would actually have been in the ending balance later on I show you where we were and adopted where we are now and what that change is um but again the uh the the short answer is uh
098just a little under $6 million uh in Improvement in the change to the uh ending fund balance this is a chart I I've shown you uh over the last nine months since I've been here uh just the comparison of Revenue and expenditures if you recall uh that final uh um stack of of bars there uh we had um not as high revenue and higher expenditures when we were looking at adoption and I mentioned that that blue bar would increase because I knew first I knew that additional onetime Revenue was coming um but we didn't have the exact dollar amount so we couldn't build it into the budget the last two times I spoke to you about the budget we have more certainty so that's now adjusted as you can see this is a very stable
099Trend over a long period of time in this District of having as near of a balanced budget as you possibly can uh over the course of many years highlights on the first interim Revenue uh you can see uh lcff property tax essentially flat uh there is some change in the federal and state revenue uh the increase in the federal revenue is interesting because it's much of that are dollars that we would have considered uh state revenue from the expanded learning opportunities program program the state is getting that from the federal government and we've had to reclassify some of that as federal revenue and so there have been some movement between uh between State and and federal um but we also have a number of additional one-time State programs uh that are now built into the
100revenue budget and here they are so you can see expanding learning opportunities Grant which uh which the board is aware of educator Effectiveness uh on the consent agenda earlier you approved that plan plan after discussion at the last meeting uh so this is onetime money that we can spend over the next 5 years uh and then a number of other programs here with expenditures as I mentioned it's typical that we see increases at first interim usually that's from carryover from other program or from from programs in Prior year uh that can then rebuild those savings into the budget and usually where we see it is in books supplies and Services that's exactly what you see here uh but we also have had uh some savings you see a big drop in benefits uh and that's
101good news on the unemployment insurance rate uh we had a much higher estimate in June uh than was ultimately uh past in the state budget act and so we were able to lower that rate and and have some significant savings so that's uh not taking away any benefits it's just not paying as much for unemployment insurance as as had originally been proposed so the highlevel uh summary of where those changes are um some uh positions scored against the uh ELO Grant uh we've received donations which cover some additional uh donation funded hours so we built those hourly salaries in uh we've had just a small amount of savings unclassified uh from positions that have not yet been filled and then benefits I I already mentioned that materials and supplies very typical at this time of
102year so uh with the general fund balance comparison this really does look back to where we thought we would be at uh at budget adoption in June where we know we are at least where we estimate where we are at first interim uh we're certain about the beginning balance everything else is is our best estimate as it always is until we get to the end of the year so you can see those changes uh how they compared to to what you knew in June versus what we estimate uh at this point uh most significantly a decrease in the uh deficit on the unrestricted side you know essentially cut in half uh still uh quite a bit of a deficit in uh on the restricted side but lower because uh we this is again some dollars
103that were uh anticipated last year that are now in this Revenue that's in this year's budget that lowers the that Gap and then breakdown of the um of the ending balance and I'll talk about uh the commitments and assignments and some movement uh that we're recommending a little bit later same update actually this is the same slide I've shown you last time so no changes to this this is just uh how we have budgeted and spent our one-time Co relief funds what's remaining is sr3 and that will show up next year uh a request that was made uh I believe is it was it on AIT to actuals was to show the between our ongoing sources of revenue versus this one-time money um so we can get a look at how are we doing on
104our general operating budget versus all of the additional things that uh we've received revenue for that we've also uh spent the dollars uh so you can see uh that were relatively stable and flat when it comes to revenue and expenditures on the ongoing side and then that green uh layer on top represents the dollars that have come in and how we have spent uh the dollars thus far so um you get and actually I show it even better on this next one um so the onetime fund the one-time funds um the top the Top Line shows when we have received the dollars the bottom line shows uh when we have or will spend the dollars uh sometimes particularly last year we had uh a good portion of State funding that arrived at the very end
105of the year so it appeared as if we had a revenue Surplus and then this year it looked like we had an expenditure deficit uh but it's really this onetime money that just crossed over the years and I think that this graphically shows that you know if I were to cover the black bar which really is sr3 uh and just look at the the dollars that we've had since uh Co began and where we expect to end this year you would see we'd be neck and neck and so when I keep saying these really balance over two years the shows that I thought I'd just give a a quick update uh on the nutrition services fund we have seen an increase in the participation uh because of uh Universal breakfast and and lunch uh now
106being offered uh so more meals is a good thing it's good for students it's also good for the uh for the bottom line of our fund 13 uh but more meals results in not only higher Revenue but also higher costs so we have to buy more food we have to buy more supplies uh and then we would have additional labor costs to prepare all of those meals and uh while this has a pretty good outlook on the on the estimate and would suggest a a modest Surplus we are concerned about continual uh continued supply chain cost pressures uh we've had MISD deliveries we've had had to have substitution of products um and costs continue to rise and so um and we might have a different story by the time we get to the end of
107the year right now though um you revenue is definitely picked up and it's just going to be a matter of uh what costs are we going to have to bear to sustain that program so multi-year projection factors uh we have updated the the multi-year projection um but all of these factors will change uh particularly as as we get into the spring and after we see the uh Governor's budget proposal and uh some of the factors like the actual cost of living adjustment uh and any um new programs categorical dollars uh early indication of our property tax revenue all of those things come in the spring and so what we have is our best estimate right now based off the factors that we have just to explain uh what's baked into the myp at this point
108uh for projecting the oute cola on the local control funding formula we're using the School Services of California the SSC dart board uh projection factors this is what we do at first interim uh they use the Department of Finance numbers which have not been updated since July uh the the legislative analyst's office has projected a much higher Cola and nobody's disputing that so we know that it's going to be higher but at this point uh that is an estimate the real number is first what the governor proposes and then finally what the legislature adopts and what the governor signs and so um we'll see an update on that and SSC will update their dartboard in January we'll build that into the second inter a multi-year projection so I already know that factor is going to
109change um with average daily attendance when we adopted the budget um you we knew that we were recovering enrollment uh this year that we had lost uh during the prior school year uh we showed a continual Andra gradual growth in the out years to try and get back on track of where we thought we were headed prior to the pandemic um but I said that we would take a look at the September enrollment and see if we beat that estimate that we had and we've come in right at where we thought we would be so because we've not grown more than we thought um I thought it was prudent at this point to just project a flat enrollment over the next two years um and essentially that stress tests are our multi-year projection uh it
110doesn't assume any growth that we haven't seen yet and I'll show you uh you know how that works in just a moment um but we've essentially built in flat enrollment until we see indications otherwise of our enrollment improving so uh x marks the spot uh when I look at this at this uh line graph here um this shows uh how we got into basic aade and how we got got back into local control funding formula and where we potentially are headed so uh as a walk down memory lane uh last year uh there was a 0% Cola on the local control funding formula while our property tax grew at just a little bit less than its normal rate but that was based on the 2019 calendar year uh that we were receiving property tax revenue
111from so that grew much faster than Cola we got to the end of the year and we just barely were into to uh Community funding status uh then this year uh there was that catchup Cola uh and that then became the megaa that uh on the local control funding formula so that jumped up uh but property tax did not grow as fast as it had in Prior years because now we were looking at the 2020 calendar year and these estimates on property tax revenue come from the county assessor and the county auditor Controllers Office office um so we base that off of what they tell us their estimate is for our property tax revenue so it's much lower it's it's slightly improved uh from where we were in June but still substantially lower um we
112we've got a a showing some return of growth uh again as I mentioned earlier we'll know more when we get into the spring probably not a whole lot more until we get into May uh on on what the final tax bill uh and and growth of the secured property tax role was for this current calendar year till they do that work and we get into the spring um but I show those dotted lines and uh the the orange dotted line shows where the Lao is going with Cola that Gray Line shows where the Department of Finance was six months ago again we know that it'll probably be more like that that orange line um and we'll see what is built into the governor's proposal but right now uh uh for a projection Factor we're using
113that Gray Line and and I'm and I'm admitting it it's going to be higher but I don't have a specific number yet to put in there because again Lao is an estimate doof is is what the governor listens to so this goes back to what I was mentioning about the enrollment Trend and projection um when I showed this similar chart uh to the board uh in in two prior meetings um those green Bars were higher and I've flattened that out the uh the orange line and that dotted drop that happens that shows the difference between our actual average daily attendance and the hold harmless level that we've been funded on for the last two years so we were able to use our 1920 average daily attendance for last fiscal year and this fiscal year for
114purposes of the local control funding formula calculation uh and that's kept the Ada steady during these pandemic years but if we had been funded on our actual average daily attendance we'd be on that lower orange dotted line um so this is the benefit of the hold harmless so we're grateful for the legislature and the governor providing that um but we don't know how the state is going to address the Statewide enrollment decline uh for next year there are a lot of ideas out there um uh but you know we're hearing uh folks say don't talk to us about hold harmless call it something else or or propose something different uh it may be that um with the additional dollars that the state is seeing they'll do something to bolster the lcff base they might put
115it in the cola they might otherwise offset that drop that they're seeing Statewide or they might continue to hold harmless in some way they might give us a new formula we're not we're not exactly sure um what we're going to see in the governor's proposal and then the negotiations with the legislature what will ultimately be enacted we'll change and we'll run all the different scenarios when we see them um but for now again for sort of stress test purposes in a worst case scenario pulling that ADA down and I have looked at it on current Cola versus uh versus the lao's cola and I'll and I'll walk through that so just a very high level when I look at the multi-year over the next this current next two years years um you this this picture
116is is relatively stable but it does suggest an ongoing deficit uh of about $3 million and that is both unrestricted and restricted uh but are we have sufficient reserves um to where we would we would still be able to maintain a positive certification which is what we're presenting this evening however if we look at it with um with the higher Cola bill this shows where we could be with this in andout of basic Aid um the blue bar here uh shows what our actual Ada uh has been over the last few years and what it would look like uh with um uh over the next two years um with the Department of Finance SSC colas built-in as they are now so you see some slight growth we actually would be in basic a if we
117saw the lower estimates on Cola in the next two years however knowing that the actual Cola will be something around what the Lao is projecting what would our re lcff Revenue look like with with that uh additional Revenue now we have the orange bars built in on top of that and you can see it's neck and neck once again uh with the property tax revenue that we come in so you know this is where it's you know at this point in the year it's not easy to PR project with certainty in which funding model we're going to be in until we know uh how the state addresses Ada loss across the state uh what the actual Cola on the local control funding formula will be if there's any augmentation to the lcff and then finally
118uh where is our property tax revenue going and so that's that's all of that built into this bar chart right here so uh running that that one more time but with the with the higher Cola uh you actually have a a a very um uh balanced projection over the next couple years that's not what is in the sax forms that you're approving tonight uh but it's just the way that we look at it and say you know all other things being equal if there was a higher Cola what would that look like it it closes that Gap in the future years so again that's why I'm confident that that we have a ve very stable Outlook so uh as I mentioned uh that confidence comes from the district being able to meet its uh State
119and board required reserve requirements for the current and subsequent two years we're able to meet uh all of our financial obligations as projected under these scenarios um I I do want to talk a little bit about the lcff stabilization Reserve uh this is something that was uh created to smooth out the differences between lcf F and basic Aid and recognizing that there are some Revenue swings that happen when you are in and out in those transition years um you know can come with some Revenue coming in and some Revenue going away and that first uh year can be Rocky well we're at that point now uh and it might happen to us a number of times and I think uh the the wisdom of the board was that we would jump in and stay in
120and and we would be good good uh but we could be fluctuating in and out and again we'll know more when we get into the spring or we'll be able to project with a little more certainty when we get into the spring I mention all of this to say it may be time to consider raising that um you know should we capture some savings this year uh and and balance between looking at you know how we could provide some additional stabilization in a in a board commitment to provide for that point when we're in flux and suddenly our uh our um supplemental tax uh our state aid and our educational protection account dollars suddenly jump up and down and fluctuate and we might be in an area where we're just kind of treading water between
121funding sources while other costs are going up I I don't have that recommendation in the actual commitments uh this evening but it might be time to think about that so these are the uh commitments and assignments uh that the board's previously considered Ed um and and those are essentially unchanged except for the assignments uh that assignment uh is the the difference between the uh prior commitments the board has made uh for band uniforms technology textbook adoptions you can read all these on on the screen um and that 5% uh board minimum Reserve so that's basically the balance that's the that's the cushion between all of those things that you have earmarked before the 5% that you require now that's the that's the cushion uh that we would have for any other unforeseen [Music] costs so
122why are reserves important for lots of reasons um I'm not sure if we've ever shown you in the past uh what our cash flow looks like and uh why reserves are so important and you know one of the reasons when you are a basic Aid District or an lcff District that has high property tax funding you're really relying on two or three paychecks a year and all of your expenditures are constant through the year and we reach a high point in January and we are on a downward slide in until we uh get to the middle of December when we get that first big install installment of property tax and so you can see the green is when the dollars come in the Orange is when they continually uh flow out um and the reserves
123help us pay for all of the things that we need to pay for on a constant basis uh throughout the year and uh you know there are districts that that blue line would go below zero uh without uh substantial borrowing uh we don't do that in this District we do some in fund borrowing uh you know if we get close to the edge on that um but there might be a time if we do not have sufficient uh balances in in any available funds and the general fund where we would actually have to borrow uh to cover a zero in November December and you know possibly even uh into the early spring and so I know this district has done that long ago uh we haven't done that uh in the recent past but I
124just want to point that out that um you know we do live on our savings for about half the year so uh there we go next steps uh tonight is uh adoption of the first interim budget and positive certification and then we head into annual budg adoption cycle uh in the middle of of January starting on January 10th and then going through uh our interim reports May revise proposed and adopted budget uh by the end of June and so that is first interim and I'm happy to entertain any questions that the board might have thank you very much Mr Jill that was very helpful I found especially the onetime fund slides were that was very helpful so thank you for adding those um board members do you have any questions um I see Miss Rollings
125and then Miss Jones thank you um I have several questions but I'll start with slide 13 um you had mentioned um nutritional services that um that uh we might be looking at a a surplus at this point point but um there are some supply chain issues Could you um tell us how we're actually funded now with nutrition services do we get a certain number of dollars per student or is it participation or how is that actually funded it's funded per meal so every meal that's sold is is reimbursable with a combination of state and federal reimbursement and I don't remember the exact number of pennies off the top of my head that we get for each meal um U the biggest portion of it is the federal reimbursement with State reimbursement on top and uh
126this is what the state has committed to continue to fund um essentially in perpetuity that is the commitment at this point they appropriated uh over $600 million um to provide this throughout the state uh to make sure that districts would be able to uh cover that additional cost uh by by providing or making uh a a reimbursable meal uh available to every student for breakfast and lunch so just to clarify that if a um so we have to have a certain amount of money uh in order to pay upfront and then we're reimbursed and then if that's the case how soon are we reimbursed for the meal um you know the federal government's is always a little late on that um we we get the state uh reimbursements sooner uh we do carry a reserve
127uh in uh in fund 13 that allows us to um uh to provide uh you know for our costs upfront and I know that you know throughout the year we do get a portion M on our claim uh with the USDA and the state of California um but often especially at the end of the year um the federal government um defers things and and we see the money later in the we see money later in the summer on up Miss Jones and then Mr Pearson thank you um Mr Dill first of all I just want to say thank you there are a couple slides in here that I have been asking for and I think my other members of the board have been asking for and so we're thrilled thank you for that um quickly
128the Tribune and other media Outlets have written about San Diego schools leaving covid money on the table for transparency sake I just want to make sure and reassure taxpayers like as we have gone through the co dollar uh I've seen you know our team zeroing out balances because we're using that money uh first of all we rarely get a ton of it but we're using it uh expeditiously and on time I just it seemed like from everything and I had not heard but I wanted you to verify because again it's in the newspapers every day I think when I go through my education news that San Diego schools are leaving money Co money on the table are we in that group no uh We've we've met every deadline we've not had to return uh a
129penny to the state or federal government um this slide tells the story um as we receive these onetime dollars we put them to work on U providing additional services for students hiring additional staff um providing you know additional classified staff to make sure that we could provide inperson instruction and we've there's a reason why that last column has a used by date so there's the freshness date and uh we always have our eye on those deadlines and and and actually the the ones at the bottom originally had a much earlier uh use by date um and actually when you adopted the budget uh we thought we were going to have to use a significant portion of those dollars by the end of this year and they later changed it to 2024 um but we had
130already committed to uh increasing Services um you know for this year which then will be continued next year with the sr3 as well so we have a plan we're using the we know uh how quickly we know what we can use them for and how quickly we need to to use them and so we're not in that boat Mr pearon and then M Rollings um Mr Dale the there was a slide on lcff stabilization arrangement I can't remember the the slide number sorry I always have a little lag when I go through this see I was talking so fast I can't remember my slide okay it was towards the end and towards the end you made a You made a recommendation that we as a board should plan on taking capture any savings to add
131to the reserve to that lcf Reserve I think that's what recommend there it is it's the bottom bullet yeah um yeah so the uh the recommendation here is we had a number of assignments those are the technology reserve the uh the technology Reserve Etc and that I had that chart showing those which are unchanged um those were labeled as assignments um what I'm recommending is that we call those commitments um because that cements the board's uh interest in preserving those uh those dollars in the ending balance for those purposes um and so it's taking the existing assignments committing those dollars putting a name on them officially uh and then we can start the conversation and consider Aug augmenting lcff um if we have that opportunity to do so by the time we get to the
132end of the year Mr Pearson did that answer your question it did but uh the second part would would have been are do you want a motion tonight on that no this is this is just me throwing out uh it might be time to start thinking about this as as I work on a a new multi-year projection when the factors become a little stronger and you know I can see where we we might be headed under a few different scenarios and if it looks like we're going to be bouncing in and out of basic Aid you know I may be saying hey we may need some stabilization and some extra dollars committed for that purpose and I'll come back to you but I'm throwing the concept out tonight with no expectation of emotion Miss Rollins
133and then Miss Jones thank you um and Mr D um my question still was not answered around uh the nutrition services um you said that it's a reimbursement but um you didn't say when we're reimbursed and so I I wanted to know when that actually occurs for those meals and then the the second part of that question was going to be um when um uh if a student is in and doesn't get a meal um are how are we how are we working with students that aren't receiving a meal due to short uh um short staffing or um supply chain issues sure to take the the first question we do re we we file our claims throughout the year we do receive uh reimbursement on those claims throughout the year like within a month within
134three months at the end of the year yeah I'm not sure the timing on the funding I know that that it's based on a a month-to-month uh claim um so it's it's it's not to the point where I'm worried that our our fund is insolvent so um I I just don't have my eye on uh when we actually get that um the uh I do know that the feds have delayed payments in the past but the state's uh pretty consistent on on providing their portion of the funding um so the claims occurred during the year um it's about just received a message it's about 30 to 60 days uh so from the time we make the claim 30 to 60 days this is why I'm so happy uh staff is watching tonight so thank you
135uh Miss iwamoto uh for providing that answer to me um see I don't have to phone a friend I've already got them they're providing the messages that's and that's exactly what I was looking for so thank you uh and then second um with respect to providing meals we uh have worked really hard to make sure that we do have Staffing at all of our sites sometimes we're a little short um but we're but we we don't shut down our kitchens we don't shut down our lines um and we always have backup food available so even if we have a uh Supply truck that we've had deliveries that have not shown up we maintain an inventory that allows us to quickly pivot I know we don't like that word to quickly adjust um to uh to
136provide an alternate meal for that day actually I was in a kitchen one morning um and uh we were supposed to have uh we I I forget what we were supposed to have we had to move to peanut butter and jelly sandwiches and there were so many kids that said oh good so even though they were expecting something else they were happy with the with what we would consider the alternate meal um and and so you know if we don't turn away kids because we don't have food um and and now with uh Universal feeding every student's entitled to be served does that does that every student is served correct every student regardless if they uh if there's a free and reduced lunch every student that wants a meal receives a meal correct correct thank
137you m johnes thank you um on the uh 88 enrollment slide Mr Dill the the Delta I guess two parts to this should there be concern for the delta between Ada and enrollment I know you have flattened us out um and then when will we begin to feel the impact of universal TK that the governor has added to our plate yeah uh you fortunately we have a um you know a gradual phase in of universal TK and so you know we'll be able to see what the demand is and build up to that um and and and it will be a a challenge to face if we are between funding models uh because as it would stand right now utk is funded in the local control funding formula so you actually when you're you're doing
138the work to calculate that um your columns are for tkk so it's you're you're adding the students who are in transitional kindergarten and kindergarten together um and you have to know what the what the split is on those but um uh but it's the state considers it one grade level uh you know for that funding model for the for the purposes of of of calculating the tion man so um you we could find ourselves in a situation where we just think we're getting into basic aid but then we grow in enrollment in at transitional kindergarten and that's enough to keep us in lcff uh or you know we we could just be right over the edge um with property tax have additional students that we will be serving that and all the costs of hiring
139additional staff and we just barely make it over the edge and lose like some of this supplemental tax that year and we could actually fall backwards this is why I'm talking about the lcff stabilization would be handy at that point because if we lose a a property tax Source when it looks like we're you know try treading water with lcff we actually could lose some revenue and and that's where we could say let's bring those dollars to cover that Gap thank you that's what I was driving at excuse me sorry Miss Rollins thank you uh my question is along those lines as well um when we're in basic Aid um my understanding is is that attendance is not a factor that um in fact um that that we won't take on additional students when we're
140in basic Aid because that takes away from revenue um so at what point are we considered basic Aid and at what point are we lcff where attendance does matter well attendance always matters for purposes of compulsory education and so uh even if uh we are in a community funded status attendance will always matter um and so enrollment that when it comes to funding I guess that we're not we're not receiving a per student uh amount and and I recognize all five of our trustees uh know that um but just wanted to make sure that from the business side the business guy is not saying attendance never matters um so the the um you do reach a Tipping Point where um you know you kind of want to accelerate your funding per student when you're in
141basic Aid and and you know you would um not be interested in taking on additional enrollment because those students don't come with additional funding um there are a few things um you know that we receive funding on a per student basis and so you know the educational protection account uh dollars are one um you know the some of these one-time uh uh funding sources that we've received have been on a per Ada basis and so you know you do get you do get a ding on that however if you're deep into basic Aid um you've you've got additional resources to cover that that loss so well my question then is that if basic Aid if if we're in a basic Aid place at this moment then um if our enrollment is flat Andor decreasing does
142that keep us in basic Aid or does that do we still move to lcff so you know all all things being equal um if we if uh if our enrollment is flat and our property tax grows faster than the state Cola on lcff we would go into basic a and continue to remain in basic Aid in in years past Pro growth and property tax almost always beats the lcff cola the funded Cola in the last few years that's not been the case as you saw in that chart it's it's gone back and forth and it's less predictable in these last few years um you know I think again I think next year we will see the the funded lcf Cola be much higher than our growth in property tax and so uh even with flat
143enrollment uh if the lcff is increased by a higher percentage than our property tax grows uh we would be in lcf um and so again even if our enrollment grows or if if it stays flat corre if it stay if enrollment stays flat um and we have a very high funded lcff Cola uh um it is likely that we would be lcff next year because uh at this point it doesn't look like our property tax will grow more than that got it okay I have a followup to that it had to do with in the scenario you mentioned Mr D about uh the Govern Governor funding the lcff base the same would be true correct because that'll just bump up the entitlement am okay I just want to confirm guess and in in relationship to
144the basic Aid Pi I think what and correct me if I'm wrong it's a piie and if people move into your District the pi stays the total whole size but they just divide it Slimmer per student so it's not like we can't we can't reject students who move into the district it's more the inter District transfer uh or intra is it inter or inter District yeah inter District transfer uh activity is that correct correct thank you okay um was that your question Miss Jones it was thank you okay Miss Rollins do you have any further questions or did that take care of it I had one more okay um as far as the um the in the summary that we received um prior to tonight um it stated that we had an ending balance up
1457.2 million and that yet we were still reflecting shortfalls in um the restricted and unrestricted funds why can't we just move part of that 7.2 ending balance over to cover those shortfalls we already have so we we build in all of the new Revenue we build in all of the new expenditures expenditures are still higher than revenue for for this current year which leaves a remaining Gap and that would in effect lower the reserves so that 7.2 all of it has been dispersed elsewhere so it's yeah because you have new Revenue you have new expenditures and if your if your expenditures are higher than your Revenue um then the Gap is covered by your reserves thank you yeah thank you very much now is the time for public comment on this agenda item Miss Garcia
146please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star 9 to indicate you wish to speak on this item we do not have any callers for this item thank you may I have a motion to approve the first interim financial report for the period ending October 31st 2021 as presented so move Jones second pearon trusty Jones made the motion trusty Pearson SEC seconded the motion trustees do you have any comments or discussion uh Miss Jones and then miss Rollings and then Miss Williams thank you president Lamson uh two um sort of General discussion points I feel like um it there might be in an upcoming presentation benefit for Mr Dill
147to help us understand the impact of ADA and enrollment uh when you fluctuate between basic Aid and ad um lcff because I think um I remember a time when I first joined the board when we tried to explain it to our constituency and it was so confusing um about the impacts and then second um I was hoping um that at some point if there were policies that we relaxed related to transfers as we moved uh into safely into lcff um that we review those as a part of the process of you know the recommendation that you've made Mr Dill so not only are we tackling it from the fiscal Side and being prudent um to cover those fluctuations between lcff and basic aid but also that we're looking at board policy that could help sort
148of um mitigate any trouble spots that we have because when we fell into basic I call it falling in because it's never really benefited car's bad um the way it has other districts that are safely into basic aid but um you know uh there were we when we fell into basic Aid last time we had a number of students that we had granted inter District transfers we want to make sure we get in front of that um if there are students that will be impacted or families that will be impacted by those changes that we may want to make thank you Miss Jones Miss Rollings um I would be in favor of having the conversation um because that's exactly what I was trying to get at uh trusty Jones as far as um uh when
149you have interd District transfers I mean there's um when you're in lcff there's advantages to the Ada formula that are not present in a basic a formula so I would um and I would also be interested in having the conversation of potentially having um formulas or triggers that would um that would allow Mr Dill to have some flexibility in making budget decisions uh between interims and adoptions but one of the other things I also wanted to state is under nutrition services I have heard multiple concerns um not only um uh the the quality of the food but that students have to take their entire lunch uh waiting in line and not being able to get food and or um deciding that it's not worth it and they go without lunches and that um there's not
150a priority for those students with uh free and reduced lunch so I do I would like us to consider and look at um how the budget uh impacts those students and how we can potentially improve and or help to stabilize uh the nutrition services budget as we move into uh ongoing permanent Universal breakfast and lunch Miss Williams thank you thanks um I wanted just to thank Mr Dill um for the thorough presentation I appreciate the slide with the covid relief funds with clear expiration dates and then the additional slides that we that are new to this presentation so I appreciate that thank you okay I believe I heard three items that I kind of want to hear to see thumbs on the first one was uh to have at some point Mr Dill present a
151presentation about basic Aid as far as kind of like a a quick overview so the people the public can better understand it Mr Dill how much time would something like that take for you to prepare I think a a good time to do that would be um when we do the second interim budget uh so that'll be in March and that will at that point we'll have more information on where we might be headed by looking at the governor's proposal and and how lcff might be affected um so that gives time to to Really Analyze That proposal in January prepare in February present in March okay uh trustees if you are interested in Mr Dill um presenting something like that as uh per Miss Jones request please show by thumbs so I see five thumbs
152okay and Mr D may I recommend that you um run it by Miss Jones uh simply because it was her request so just to make sure that that you're on the same page is that all right with you um Mr Dill and Miss Jones okay the second one is to look at transfers policy and uh I guess the question is is we are going to be reviewing board policies uh Miss Rollings and I are as well as um other staff members I think that would that if I can see a show of thumbs that we could have that be part of that of that maybe discussion at that time uh Dr Churchill it looks like you might want to say something about that first yeah thanks I I wasn't sure if I should jump in
153or not you know I'm not aware that this board took any specific action to modify board policy when when we moved between uh Community funding status and lcff funding status so so you know we can we can do a highlevel review of which policies might be impacted um when we move between funding models um uh and and it's possible to do that while we're also looking at um catching up on those policies that are our date uh but but I would uh I would request that you let us get through the backlog first uh and then maybe at the same time that Mr Dill is looking at uh the second interim presentation that we could we could have a discussion about uh potential board policies does that make sense I just want to set an
154expectation that that might not be the first thing we do in terms of policy review uh thumbs if you agree with uh support what Dr Churchill said I see four thumbs okay and and one down okay all right that's what we will do and the a third item was regarding um nutrition services and I and I think what I heard is that perhaps we need to have a uh some type of a of a report of the state of the of the services if um and if you have some specific cases Miss Rollins maybe you could share that with Mr Dill and so he can get the that feedback from you and then and then then he can if if if we need to to address that further we can do it at that time
155um can I have a thumbs for supporting uh that part of it that um um that we would have if it if what if if there a report is needed we could get like in in just in in a report from Mr deal and if but if we need to have a presentation at at a board meeting that decision would be made at a future time president Williamson yes can I just have a clarification on what you're suggesting do we in know in our weekly report do we get or could we get you know complaints and specific complaints that transcend by school or or location School site uh on nutrition I mean I I I feel more comfortable if we'd have a more Global um understanding of how big this scope of the problem is
156before sending Mr Dill off into doing some reporting or anything if if that's captured already Mr Dill um in ter well uh you know we can certainly provide uh information on this the state of the nutrition program um you know the challenges that we faced with supply chain with you know meeting all of the needs and the quality of the food that we have and also the Staffing challenges that we've had that may lead to some of the concerns that trusty Rawlings has heard uh you know and what we're doing to attempt to uh you know provide staff as quickly as possible and keep them there and trained and and so that we can provide meals um and we can certainly do that in a in a future meeting um uh you know I think
157it it might be better to do it that way rather than uh in a in a weekly report type of format um um because I know this is something that's of interest to the trustees okay would you show a thumbs if you're interested in having uh uh yes Dr Churchill sorry I was just hoping that you would um re restate what's being asked for here because I I lost the thread I believe that what is being a actually miss Rollins why don't you state what it is that you're requesting and a quick request can you um describe how it differs from what Mr Dill just described to us the only um difference is the um is also the prioritization of um lunches received um prior to the universal lunches and breakfast um there was um
158it was uh folks that qualified for free and reduced lunch now it's whoever gets to the line first and that's a big concern of mine I'm not sure what you mean by that Miss Rollins that um that because everyone qualifies for a breakfast and a lunch right there's not a prioritization of who actually needs a breakfast or a lunch it's whoever can get whoever gets to the line first gets their breakfast or lunch where what I have heard is there are multiple students that are not receiving lunches that would otherwise qualify for free and reduced lunch so I have a follow-up comment to that Miss Jones in discussion I guess my question to you trusty Rawlings is is your proposal then a a recommendation that students be singled out by free and reduced lunch and
159led to the line first I I don't I want to get a report of how often is this happening is there a prioritization or is there not a prioritization this is a brand new program and there doesn't seem to be specific processes that have been implemented um on a districtwide basis and I've heard I've heard complaints there's complaints on social media I mean if you go through social media there's complaints on social media about this yes yeah if I could just jump in real quickly I just want to make sure I think trusty Jones um her comment was was accurate that um you know we're not even able to disclose the free and reduce lunch status of students um and so I don't believe at any point in in our lunch service program we've we've
160uh put those students to the front of the line and we in fact take great go to Great Lengths to ensure the confidentiality of those students who qualify for free and reduced lunge so so I don't think that's a new thing um and you know I would ask that if there are complaints about the specific meal service at a specific campus that first that be brought to the attention of the school administrator or or the lunch service workers um and it certainly can be escalated up through chain of command here and it can get to me if if necessary but you know I've not heard that complaint and I'd be interested to to have that go through a a standard kind of process I think the folks at the school site are best position to
161speak to and and resolve those issues um so so you know I would ask um you know anyone who came forward with a complaint to to kind of direct people back to the school site and then escalate as needed thank you Dr Churchill so Mr Dill the the the what you had said that you would be coming back probably as an agenda item uh that would address the some of the issues that have been occurring um that could be maybe within two or three months you think that would give you I think we could get that in February okay a good tea up for for some other issues as it relates to collecting information on on socioeconomic disadvantage students and how that feeds into the LC cff um that we've also had great would you
162show thumbs board members if you would like to have that report at in upcoming meeting okay thank you we will now um U I believe that that was the I don't see any other hands and so um Miss Garcia would you please call for a vote trusty Jones yes trusty Williams yes trusty Rings yes trusty Pearson yes trusty Williamson yes thank you very much and thank you all for the conversation for the discussion we now move to um item 9.3 this is the time and place designated for the public hearing pertaining to annual and five-year reportable fees report for fiscal year 2021 I declare the hearing is now opened and I'm having to use this um a mallet because I don't have a C thank goodness I have a husband who's a carpet um Mr
163Dill superintendent of assistant superintendent of Business Services will introduce this item thank you trusty William I would have done this this is an annual item for the board to receive information related to the developer fees that have been collected during the last fiscal year and how those fees were used uh you've opened the public hearing which is required and and uh following public comment you you may close the hearing and following that that hearing and board discussion it'll be our recommendation that the board approve the resolution that adopts the annual and five-year reportable fees report uh which is in compliance with the government code um there's information in the report that that details what we've received and and how we've utilize those dollars so if you have any questions on the report I'm happy to
164answer those um but we may proceed at this point okay trusty Rollings have any written comments been received from any person as to this proceeding no written comments have been received now is the time for public comment as part of this public hearing Miss Garcia please call for public comment if any member of the public wishes to provide public comment on agenda item 9.1 public hearing and resolution number 20222 adoption of annual and 5-year reportable fees report for fiscal year 2020 21 in compliance with government code sections 66006 and 66001 now is the time to do so if you are on the line press star N9 to indicate you wish to speak on this item we do not have any callers for this item hearing that there are no comment comments I declare the hearing
165is now closed May I have a motion to approve resolution number 20 2122 adoption of the annual and five-year reportable fees report for fiscal year 20 2021 in compliance with government code sections 666 and 661 developer fees exhibit so move Jones second Williams Trust Jones made the motion trusty Williams seconded the motion trustees do you have any comments Miss Garcia please call for a vote trusty Jones yes trusty Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes that passed unanimously we go to item 9.4 updated procedures for public participation at board meetings this is a discussion action item Dr Churchill all right thank you very much give me a moment I'll get the slides on the screen here there we go uh so this evening uh We've agendized this item as background at
166the November 17th board meeting it was truste Williamson who requested that staff bring back draft language about public participation to this meeting uh in advance of uh the eventual return to in-person meetings um attached to the item staff prepared four documents uh labeled exhibits a through D the first is a general um landing page and and each of these are intended to be um found on our website upon board approval the first is a general landing page for information about board meetings exhibit B is a statement on face covering requirements at board meetings Exhibit C is a description about how to provide public comment at inperson board meetings and then exhibit D is about meeting to Quorum I'm going to go through each briefly I'm not going to pull up the exhibit uh those are
167available via board docs uh the slides here just give a brief overview of the the highlights of each of those exhibits uh so in exhibit a we'd be indicating that um board meetings there's a typo there board meetings uh will be scheduled to be held at strick high schools Performing Arts Center uh for for the near future uh in the case of schedule conflicts we will look at the cultural arts center at carlbad high school as an alternate venue um and we've committed to continuing to live stream in real time via YouTube our board meetings for viewing at home in real time and and benefit of that is that it's also accessible on our website for on demand viewing at a later time exhibit B um when we published the the uh board doc I'm
168sorry when we published the agenda to board docs uh that was before we knew that uh cdph was going to implement a new facial coverings requirement uh indoors in all settings in the state of California so so here um the top half of the page uh was the slide that I initially put together uh and it corresponds to what you see attached to board docs um prior to the announcement of a universal indoor mask mandate in California um our recommendation was in alignment with uh current cdph rules um that anyone who is not fully vaccinated against covid-19 would be required to wear a face covering at all times while in attendance at board meetings uh and those folks who are fully vaccinated or exempt per current cdph rules would not be required to where a
169face covering um would be encouraged to and certainly would would not be prohibited from doing so um now uh as of today that that change cdph has initially said their their new order goes through January 15 um we'll see if if that in fact ends on January 15th or it gets extended again uh but the current rules um are that all persons would be required to wear a face covering at all times while in attendance at board meetings because those are indoor functions and less exempt per current cdph rules uh so when we um ask you to approve these documents this evening there is the one caveat on exhibit B that we would be modifying the language in that document to reflect whatever the current cdph order is regarding masks Exhibit C goes into how
170to provide public comment um so you're aware that in in government code members of the public May provide public comment on all agenda items and on all non-agenda any non-agenda items as long as it's within the subject matter jurisdiction of the board we have um a Time following staff's presentation on each agenda item for public comment to be received uh we also have a Time designated on the agenda for public comment on non-agenda items um it's important to note as it says in our board bylaws and um in board docs that that the board won't take action or discuss any item unless it's been posted on on the uh agenda in advance uh continuing here uh our recommendation is that public comment be provided uh at in-person board meetings in two ways uh number one
171in person uh or number two in writing via email um so let me walk through the recommendation here in-person public comment uh we hope returns to the way that we've always done it uh you attend a meeting you pull a blue request to speak form you submit that to the recording secretary Miss Garcia prior to the beginning of the presentation on that item and then uh when it's time for public comment we we go through and we call people up to the podium based on the blue card submitted uh we'd like to add to that a second method for public comment and that would be to accept written public comment uh we'll establish a email address clerk carlb usd.net uh and we'll be clear that um that's the email address for submitting comments to be
172included in the record board meetings we would ask that the agenda item be included in the subject line um uh and we'd follow the process that carlb city council has used for some time um effectively uh that any email that was sent to that email address received by 2 pm of the day of the meeting we would um PDF all those up and send them to the board so that you have time to review those written comments in advance of the meeting uh and and then any comment all of those plus anything that was received from 2 o'clock till the time of the meeting all of that would zipped up and included as a link in the in the minutes of the meeting so that there would be an official record of those comments just
173like the person who comes to a meeting and uh speaks into the microphone and has their public comment recorded as part of the video recording so too would those who submit written comment have their comments be recorded as part of the written record published on our website and accessible to anyone and again we took that procedure from from the city of Carlsbad for their City Council meetings uh continuing um highlight a couple of things relative to the amount of time that participants have to provide public comment per our board bylaw 9323 individual speakers are allowed up to three minutes to address the board on each item and and we've allocated 20 minutes for public comment on each item in an effort to hear as many speakers as possible comment times may be shortened this is
174highlighted in our board bylaw and on our website and in our um board docs uh but but per trusty Williamson's recommendation staff agrees that we ought to be explicit about the manner in which we may shorten comment if there is the volume of comments um that that on a particular item so we recommend enumerating seven or fewer speakers each speaker be given three minutes that keeps us within the 20 minutes allocated for item if there are eight to 10 speakers we limit them to two minutes if there are 11 or more speakers we limit each speaker to one minute and if there are more than 20 speakers which would consume more than 20 minutes um all speakers who are not able to speak during that 20 minute time period uh uh would have the opportunity
175to address the board later on in the meeting we would set time aside at the end of the meeting to hear all additional comments so um this is in practice what we've been doing for some time but it hasn't been specifically enumerated like this we think for transparency this this would be helpful um and then to be clear that one speaker's time may not be seated to another speaker if if you're allocated three minutes but you only speak for one minute um it would be the board's policy to not allow you to transfer those minutes to someone else uh the final exhibit D on meeting the Quorum um is an attempt to be explicit about expectations so that we can have the most successful meeting of of the board's business as possible so um and
176and and all of this none of this should be new uh the recommendation is that we enumerate here one all participants are expected to conduct themselves with mutual respect uh two uh this is in our um governance handbook I believe but but to show support or agreement with our speaker our practice is to hold up our hands and and wave our fingers uh that that allows the board to continue meeting without um significant timely disruptions uh we're we're asking participants to refrain from um boisterous and unruly Behavior because it interferes with the ability of the board to conduct the school district's business uh for our in-person meetings we're asking for one person at the podium for at a time um with the exception of young children sometimes we have kids who'd like to come address
177the board and certainly we'd invite um an adult to company a child in that manner um per the Fire Marshall we want to make sure that all aisles and designated Pathways fire exits Etc are clear at all times um and and we're asking um everyone in attendance to please be sensitive to those who wish to socially Distance by not congregating in doorways and aisles uh finally the exhibit D has a copy of our board bylaw 9323 and and it describes um the actions the board president shall take in the case that there are disruptions to a public meeting none of this is new this is all in our existing board bylaw so um I know that was a lot of information uh for our process here we would take board questions public comment um and
178then a staff's recommendation that that you approve the updated procedures as described in exhibits a b c and d with the understanding that exhibit B will be modified to comply with whatever the current cdph policies are uh and I'll pause there thank you very much Dr Churchill are there any questions um okay Miss Jones Mr Pearson then oh everyone has questions okay we'll start with M Jones Thank You president Lamson really quickly um number eight on slide seven I just want to for transparency again um the the that verbiage will that be placed on the blue card I just want to make sure that was a recommendation we received in a prior meeting yes and I'm sorry I I wasn't explicit about that not yeah we'll update the blue cards we'll update what's what's displayed
179publicly at board meetings website board docs uh Etc yes thank you Mr Pearson Dr Cher was there any conversation when we're putting this together with cabinet um in Li of what we've experienced with the pandemic and Co and behavior changing in terms of calling in that we continue to give opportunities uh to call in ask questions yeah yeah we we we had the discussion um uh we eventually landed on the idea that we we'd love for for people who are interested in the business the board to attend the meetings and um you know certainly um if so directed by this board uh I'm confident that we could create a hybrid scenario where where folks could call in to provide public comment um while we're while we're in person but at this point it's our recommendation
180that we um uh encourage participation by attending meetings and and certainly acknowledging that there are folks who might not be able to make it um and and in that case we would recommend uh written public comment Miss Williams thank you um how for exhibit B or the mass mandates are the current ones um how are is that going to be enforced how is the uh Mass requirement going to be enforced uh that's an excellent question um uh assuming that the mask mandate is still in effect when we go back to inperson meetings um that's a discussion that we're going to have to have um I I am increasingly uncomfortable with the idea of one of our regular certificated or classified staff members um uh being responsible for enforcing uh uh masks in our public meetings
181um so we'd want to take a take a look at um potentially Contracting out to have some additional support uh from from folks who would help us to ensure uh that that everybody's following the rules um uh but but that's most certainly something to take into consideration uh when when we do think about going back in person because um again I'm not sure that I want one of our regular classified or certificated members being the the person barring the door uh to to enforce that particular rule that's come down from the state Miss Rollins on that one um how are masks enforced now currently during the day in schools uh so staff at the school site ensures that uh folks who uh are on campus are wearing the masks um the difference is in my
182mind um that uh we fully know and understand that that it's a requirement um we have limited visitors uh on campus those folks who are there are there for school business and generally their parents um and so we haven't had a a real problem with willful willful Disobedience of of the of the law um I think it's possible that that the scenario might be a little bit different at a public meeting of the board as opposed to a regular school day the I'm not sure you answered my question so when you say staff is that custodians the principal who's enforcing it at the school sites well all staff on the School site are responsible for ensuring that kids are wearing their masks that visitors are wearing their masks so so from the principal down to
183classified staff in an office to campus supervisor to teachers and classrooms Miss Williams thank you for um the meeting to Quorum um how if it gets interrupted um the board's business how will that be enforced so you know our board bylaw right now um includes that the board President should should be the one to um terminate the privilege of addressing the board um Andor uh asking that individuals leave the meeting um you know we'll work with with uh carlb police department to have uh uniformed officers at our board meetings um you know that's a common practice and uh we've got a great great working relationship with the city of carlbad and the carlb police department um so you know I think we'd be talking with them in advance of our next inperson meeting about um
184you know practices to be employed in in in the case that a meeting is willfully disrupted thank you Miss Rollins you have your hand up is it you have another question or were you yes I have several okay and I will follow up on um the last one um uh as far as um meeting deorum does uh Robert's Rules of Order or other um governance meetings uh would it allow any trustee to step in if those rules are not being followed and the president is not enforcing them um well I think you know any any trustee could ask uh you know have a process check and ask that the board president is in fact you know complying with our with our own bylaws yes okay go ahead Mr Rollins that that was my question I
185wanted to see if that um because it does say the president may do this the president may do that and could a another trustee step in and say hey process check this isn't happening or this should be happening or something like that thank you did you have any fur I thought you said you had several questions do you want to goad okay go ahead am I the only one you're the last one left okay um when you talked about the the live stream with the YouTube um how would that be different than um how it is right now with the live stream on YouTube well so uh if we're on the stage at Sage Creek High School we'd have a couple of cameras set up um connected to our mic system and then that would
186be broadcasting to YouTube um uh in that manner so it wouldn't be like we were before when we were on zoom and we were looking into the a computer um correct correct if if you recall we we did this once uh in July and uh uh we um were not looking into a computer speaking over Zoom we were in a room the Das was rather large to allow for some distancing uh we can we can reconsider what what that needs to look like when we go back to inperson meetings but no we would be talking to one another um and because we're miked uh that audio would all be picked up so the video uh and the audio would be pushed out together via live stream okay and when you talked about calling in um
187would the only way that there could be a call in would go back to the zoom or could there be a call in with this the new and improved version of YouTube live streaming yeah we we can um investigate the uh best technical mechanism to accomplish that um you know this question came up at carlb city council meeting yesterday I I heard the city manager report back to city council a similar question and um he he thought you know it's they requested a period of a couple of months to determine the best way to make that happen and um indicated there'd be a cost involved um you know we don't run quite as professional an operation as they do in terms of our live stream they've got a team of people and and uh um
188some some pretty nice equipment to to help them uh we could probably be ready to come up with a hybrid situation sooner than that um but again it's not staff's recommendation at this time to do that okay I have a few more questions can I keep going okay I'm not hearing any no um when you said that um board members would would receive written comment um by 2m of the day of a board meeting how do we know that board members would have the time prior to to a board meeting to read those written comments I don't know that I am merely promising to send it to you by 2 pm that day city council I believe gets an update at like 10: in the morning and then another one at 2 in the afternoon
189uh so we we could talk through and by all means we're open to um a recommendation for ways to streamline that process uh that's you know understanding you're all busy people I I get that right I'm just saying that on the day of um and then would the time be shorten are you recommending that the time be shortened um during the meeting by the time of the written comments or the written comments could go as long as they need to but the the the comments at a meeting would be shortened based on the time frames outlined is that correct that is correct yeah the the the number of people wish to speak to an item would drive how much time each person gets up to a total of 20 minutes per item whereas written comment
190um you know we would accept as many and U you know as much volume of comment as we would not limit the number of written comments no and my last question is um have have we received any type of a legal opinion of um if that could potentially be seen as any type of disenfranchisement from somebody that um as far as safety's concerned um attending a meeting versus not attending a meeting and having their comment way heavier or influence the board more than a verbal comment no we have not okay thank you all right may I have a motion to approve the updated procedures for public participation at board meetings as um as presented with the modification that Dr Churchill mentioned so moved Jones is there a second I I will second it Williamson okay
191um so uh trustees do you have any um disc is there would you like to discuss isn't this public comment didn't we already do that not for this item I'm sorry okay just having sat in your seat recently I'm Cadence you're welcome thank you so much all right yeah I skipped I skipped the whole page now is the time for public comment on this agenda item Miss Garcia please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so so if you are on the line press star9 to indicate you wish to speak on this item one caller has indicated they'd like to speak on this item as noted in our agenda no individual presentation shall be for more than
1923 minutes and the total time for this purpose shall not exceed 20 minutes ordinarily board members will not respond to presentations and no action may be taken however the board may give direction to staff following a presentation speakers are asked to State their name and indicate whether they live within the boundaries of the school district when we call the last four digits of your phone number press star six to unmute you will have three minutes we will have the timer on the screen and we'll mute your mic when your time is expired the first caller is 9850 good evening trusty it's shaa Hurst and yes I am in the district it's exciting to be back I just um wanted to say a couple things that are great with this new policy is love the written
193comment Poss um possibility when we're back in person and I just wanted to state that um I just don't think for um I think it's Exhibit C number 4B for one minute per speaker well it's just really hard to express any coherent comment in one minute um especially if we have 20 speakers who are probably fairly heated on a topic if we ever have that many speakers that limiting to one minute might kind of rile everyone up and not having ability to speak a long time so I just I feel like we've done a great job in the past allowing for more time if we have that many speakers as you know I've attended many meetings and really the it's very very rare that we have 20 speakers per topic or agenda item we only
194have 10 people watching the meeting tonight so we even rarely have more than 10 people viewing the meeting so I just wanted to throw that out that I think the one minute is just a little on the short s side someone who has spoken many times in the board and I also wanted to say one of my um issues as a participant as we continue if we meet continually not meeting in person is that when I am currently now giving public comment I can't see the trustees so I I know the trustees and I know you're listening to me right now but there's really no way for me online to know that you're actually listening during public comment time so if we continue to meet virtually I would love to have the ability to see
195the trustees during the public comment time um just as best practices for public comment to see you and I hope we are in person soon as well so again I think a lot of this policy that we went over is what we've been doing and it's great that it's in there for people who don't attend the meetings as often I do and understand that and would like to just make sure that we see it across the board enforced I've we've had several meetings in the past where um we haven't been necessarily consistent on some of these rules but I think it's fantastic that we're documenting it and we'll be able to do so moving forward so that's it um two minutes wrapped up so two minutes a great amount of time time one minute's not
196enough thanks uh thank you so now may I have a motion to approve the updated procedures for public participation at board meetings as presented with the modification from Dr Churchill I have a quick clarification for staff question go ahead based on comments made by the caller have with these proposed changes Dr Churchill have we removed the um part of the policy for the ability of the board president to extend the total time from 20 minutes to another length notop sorry not intentionally um let me just double check the uh the exhibit itself sorry I didn't have it um in front of me uh but no the intent is not to remove the board president's ability to extend the time um so so yeah it's not listed as such um sorry I'm looking for it yeah
197but but with um you know consensus from the board we'll ensure that that remains in the policy so uh I would like to make a motion to accept staff's um recommendations with the addition or inclusion of the full board policy n board policy 9323 to include the ability or flexibility for the president to extend the total time I second that thank you okay so now um any comments or discussion okay I'll just uh I would like on if we could look at slide eight for just one second and this is just surprise surprise a wording thing um to just to be consistent for the I'll wait till it's on the screen I'm sorry which slide was it it's uh slide number eight page eight I believe this is it yes so for the first one
198I would if it just we consistant so we start with please whatever it is it would be please show respect for all those in attendance and then the third one it would be please refrain from so it would be the same intent but it would just be consistent and and in a maybe a more positive um positive verbage so the first one would begin [Music] um now I've lost it it would begin I I think I understand please show respect for those in attendance and then the third one would be please refrain from whistling and all that so that that that would be the only change that I would recommend um um okay so let's see Miss Williams then Mr Pearson okay um the three uh the three feedback the three items I wanted to
199put um feedback on is to request staff to hire a third party to enforce the mass requirements or whatever's in um complying to whatever order is in place second would be to keep the option for the public to call in and third is to request staff to work with CDP carlbad Police Department um to make sure they're available if needed for the meeting to Corum if we have any issues okay Mr Pearson you're muted trusty Williams uh took what I was going to say about uh ability for people to call in but I was going to add to on the Callin that it didn't take excessive staff time or excess uh budget uh to accomplish that for the which one Mr Pearson to call in that speakers have the ability to call in on agenda
200items okay um Miss Rollins um as written um I'm not comfortable voting in favor of the um of the policies and procedures um mainly because we don't have an we don't have the enforcement mechanism written in as far as a third party or what have you and that hasn't been um uh suggested or approved and that's in the motion as well as um uh the difference between um written comments and spoken comments um I am concerned that um uh I don't always have hours and hours to read comments and I do believe that um that everyone's comments is important and so if they are if they don't feel safe in attending a meeting and or there's um not enforcement at this time and there's no call-in option I believe that there could be disenfranchisement issues
201so I have uh real concerns about that and until there would be a legal review on that I wouldn't feel comfortable there um I also would am not comfortable with um uh uh with the um as the caller stated um with the the deescalation of time and so it would automatically go from one amount of time to another amount of time not knowing that we may have five callers that all or five speakers that only speak for 30 seconds and therefore there could be two minutes available for each person so I'm not Co I'm not comfortable with the um with the amount of time speaking with the lack of enforcement built in without a call-in without um uh assurances of a third party and without um equal time for comments for all those reasons I'll
202be voting no okay um any other comments um I will be um I actually support the um the the change in the the call-in I believe that having the written comments my guess is most people could have them to us well before the board meeting uh Dr Churchill I I apologize for asking for not asking before but if comments were received the two days before you wouldn't necessarily have to hold everything until 2:00 on the day of the meeting correct you would give them to us um in advance that is correct yeah we could do a batch on on Monday a batch on Tuesday a batch on Wednesday morning at 8 am at 10: am at noon at two yeah so we would we certainly could do that okay all right um and uh and
203then let's see the the option for having a thirdparty enforcer enforcement of the Mask mandate I support that um let's see the option for okay let's see okay and then and then the reduc process check yes that's um none of this was in the motion so I'm not sure how we bring this this is I believe we're in discussion and so while we are having our discussion and then we're going to hear what everyone says and then we're going to see if there are three people who support the various changes and we may need to amend the motion but we need to have the discussion first but are okay we're not discussing the motion that's on the floor we're discussing how the motion would be amended we're having a discussion on this item just like
204we do whenever there's a motion on the floor we're discussing that item that's when like like with the with the um first indrum we're we are discussing all sorts of things related to that agenda item we so we're discussing things that are relative to this agenda item um so let's see um and then as far as the the reducing time I believe as long as the the board president has the latitude to extend the time I but the reason why I think it's important to show that is and and often in the past when time has been reduced I don't think that people are aware that that could happen and that's extremely frustrating to have something prepared for three minutes without having any idea that you might have to have it be shorter than that
205and so I think that by having something written that explains that yes you know if there are a lot of callers it may be two minutes and if there that it could even be as short as one minute I believe for the sake of transparency it's important that that be that that be available it might not necessarily be enacted in every in every case but I think that it I think people have a right to know that that could happen um so anyway so those were those were my thoughts is there any other discussion okay so what I'd like to do is and I yes Veron Miss Miss Williams sorry no I I I agree with you in terms of I appreciate the the re worded about the about the minutes being shortened so I
206appreciate that because that we know that but it's clearly stating to the public so they are aware okay so I need to make sure I'm prepared to shorten my sentences um so I appreciate that do you need because I won't approve this unless there is an enforcement with mask requirements uh I want to make sure that there is an option to call in so I are you gonna break it up yes okay that's what that's that's my next step so what I'm going to do is and if I'm missing something please point it out so the first item that I had put down was the um the enforcing the mask requirement and I don't know that we want to say have it be a third party but I my guess is from do when I
207heard from Dr Churchill that that would be what he would be recommending but that there would be some component that would be part of this that would be Rel relative to the enforcement of a mask requirement so could you show thumbs that that is an important part that that you do want that to be included okay so four people it looks like do want that to be included okay the second one is the option for the um public to if if you want to have added that you want the uh public to be able to call in live rather than providing their um email comments beforehand show your thumb if you would like if it's if you want that to be changed okay so that so that we would need to be um changing it
208so that that that would be I have another process check this doesn't make any sense to me when we have a motion on the floor don't we have to vote that motion either up or down and then make a new motion based on our discussion what what my thought is and I had talked with Dr churel about this is that once we know what the majority of the board is recommending we will ask the person who made the motion to amend the motion and I believe that was Miss Jones did you make the motion and so let's let's get to where we need where we where we know what we want it to be amended to and then we can amend the motion okay I I object to the process at this point because it
209doesn't it's it doesn't follow our normal protocols when we have a motion on the four floor we don't then go through different components of it in order to vote it up or down so you would rather us vote it up even though we don't agree or vote I would say vot down like I I said as the motion is written because it's staff recommendation I said I would be voting no because of these particular components so that was my plan is to vote it no and then maybe make an make a new motion once we know where the board stands on things but to me it doesn't make sense to have a motion on the floor and then basically Whittle it down to change the motion completely and then vote on it that doesn't make
210it we've never done that before that I'm aware of okay we have in the past we have done it this way but and so I'm comfortable continuing this way but I'll ask board me the the rest of the board members are you comfortable continuing doing it this way and if you are just if you could show your thumbs up okay so four of us are comfortable continuing to do it this way okay thank you so um then the third item is that we need to to um have to work with the with the uh Carl's police department and I believe that Dr Churchill had already said that he would do that so I I I don't think he even need thumbs on that one because I I Believe Miss Williams he had already said he
211would do that okay all right uh and then um the next item was to have a a legal review but that legal review was if we are not going to be having um callers be able to call in and since I believe the board majority is saying that they do want callers to call in we don't need to get a legal opinion on that and then the fifth item that I saw was was the reducing time and I think that we that we've had that conversation that the board president would have the latitude just as they do now to lengthen it or to um and typically the board President says um board members do you you know would you go along with um you know lengthening the time by five minutes or or whatever it
212is but but it it would be up to the board president so as long as let's do let me see a thumbs if you are all comfortable with and I so I believe it would basically be leaving the language the way that it is but other than adding the the sentence or whatever it was in the in the existing by bylaw about the board president having the latitude to extend the 20 minutes so are we all okay with that okay so I see I see four thumbs to that all right the challenge Miss Jones is are you willing to amend your motion to reflect the conversation that we just had about third I still had one other item oh okay yes Miss Rollins what was your last item um the other item was um that
213uh um that who's going to enforce um individuals speaking to agenda items specifically for instance this evening a speaker called in and was saying that they were speaking at for closed session but nothing was that the speaker spoke about was in Clos session oh I'm sorry I didn't hear you say that before um no that was another item I wanted to bring up that wasn't um that but as far as ensuring that members of the public are speaking to an agenda item rather than um or speaking on non-agenda items so does that make sense that um that if somebody speaks and they say I'm here to speak on agenda item 7.3 and they speak about something completely different is that also uh part of the enforcement or part of the policy what would your recommendation
214be in that situation that the speaker be um asked to um to to stop speaking and uh speak at the appropriate time on the agenda for that topic because they have a right to speak they just maybe not they may not have the right to speak at the time they're speaking I believe I have heard last year Miss Jones do that as as the board president that if I don't recall that you okay okay I recall people being able to people speaking at different times and it happened tonight and again I it didn't need to be stopped because there weren't a lot of people but if we're going to have these types of rules then I do think that that's going to need to be enforced um what uh oh I'm about to lose my
215computer my okay I'm back um I would recommend that when we have our board governance Workshop we have that conversation because I think this is something um that's really is a um as a governance manual I believe that we could have the deal with speaker time as we were just saying that it's 20 minutes per agenda item and then if it's a non-agenda item and who gets to speak when so that's why I'm bringing it up now okay uh Dr Churchill do you have any input on this um certainly you know I I think it it's already within the purview of the board president to redirect a caller if in fact or a speaker if in fact they're speaking not speaking to the correct item um you know as I reflect on on what happened
216earlier this evening you know it was um five minutes into uh trusty Williamson's tenure as president that that this occurred and um uh my guess is that that moving forward we've all now been aware of the fact that we should be attuned to whether or not someone's speaking to a specific item and and I have the confidence that that the board president um would be able to address that in real time um moving forward so I'm comfortable uh but should the board you know like to have thumbs on that uh that that can certainly be helpful as well um you know what I wrote down was that the board president will ensure that speakers are addressing a specific item at the correct time on the agenda um you certainly could could give thumbs to on
217that and then that empowers our board president to speak up yeah I would like to have see the see the support of the board members if if you if that's something that as the board president you would want me to enforce I would like to see the thumbs on that okay all right then I will I will I will um I will do that I guess my question is is that can that be would that be included in this new motion I I believe that that's part of the responsibility of the board president that could be put in the governance handbook where it talks about the responsibilities of the board president that's where I was okay so this would not be part of this um this motion it could be I don't think that it
218needs to be but but if you know it could be so I you know I'm fine either way um so I believe that that we I went through the items that we would be amending is there any question about what what those items are before you U agree to do the amended motion Miss Jones I'm sorry I say that again I was reading board policy 9323 because I think it's in there about board president redirect but I just wanted to confirm so okay than so I am amending my motion to in include the five uh items um that the board had majority consensus for that include um the flexibility of the president to extend the time or reduce the time per speaker as uh stated the second was um to have staff explore um and
219we didn't want to use third party but an outside or uh a firm or some consultant to uh enforce mask mandate to provide a call-in option and for staff to um invite police presence uh which we would do ordinarily um and did I miss one I think that was it I I second that amended motion now is there any discussion okay um Miss Garcia please call for a vote trusty Jones yes trusty Williams yes trusty Rollings no trusty Pearson yes trusty Williamson yes the pass the vote passes four to one thank you for hanging in there with me on that conversation that was helpful we now move to item n 9.5 resolution number 20 24- 2122 uh this is a discussion active action item Dr Churchill thank you slide deck up on the screen there
220we go um as you're aware uh AB 361 requires us every 30 days to make a resolution um allowing us to hold virtual meetings um sorry sorry too many windows open uh so that's what we're reviewing this evening um as we did at the last board meeting um each time we've brought this item to you we have looked at a couple of data points the first is as San Diego County reports uh uh levels of community transmission um uh this is based on those CDC levels of community transmission I pulled the slide down this evening the county of San Diego reports on uh case counts and case rates every Wednesday so this is this is hot off the presses and you can see in the last two weeks of reporting San Diego County has been
221in the high transmission category according to CDC levels of community transmission uh this slide is taken from the County's report uh showing uh that you know recently we've seen an uptick in uh the average daily cases the orange line is not fully vaccinated the blue line is um the county overall and the green line is fully vaccinated so you can see an increase uh recently fire chief presented this information at the city of carlbad meeting yesterday Active covid cases um by week uh currently well this data is a week old that he presented but we had 208 Active cases in the city of Carl's B had um a high of 400 Active cases in August and it's kind of leveled out to about 200 cases a day uh so certainly not not back down to
222the 20 or 30 cases we saw in June um the city manager put together this uh slide and the fire chief presented something similar yesterday to city council um essentially showing the the um CDC levels of community transmission the county overall is in the orange or or substantial transmission category uh the city of Carlsbad overall is in the orange or substantial transmission uh but then our different zip codes range from moderate Transmission in the 92011 area code moderate Transmission in 92008 and 92009 and high transmission in the 92010 zip code um uh it's important to note as part of this conversation as was referenced earlier that the the state did Implement a new masking requirement for all indoor activities effective today going through January 15 at least that's the stated date that that that's currently
223in effect um this is the website that I pull a lot of the data down from I I just wanted to make sure to call your attention to the fact that the county has a lot of data um they also published their um uh their Public Health orders here on on this website Health officer orders are found there um there's a number of Health officer orders but you know one of them as an example is the San Diego County uh Health officer order on quarantining um and and so it can be confusing sometimes to know where to go to get what information uh the masking requirement The Mask mandate for indoor in California you'll find on the State website uh the quarantine order for people who have been exposed uh as close contacts uh you
224can find that on the County's website um so we're beholding both to the state of California and the county of San Diego uh you know it's not our rule for example that if you're an unvaccinated uh close contact of someone who's covid positive that you have to stay home for 10 to 14 days that's that's the county health officers Rule and uh and again I just wanted to call out the difference in in the types of requirements were hold to both the state and the county uh so other information um so live stream via YouTube as we mentioned uh so while we have uh if we return to inperson meetings those will be live streamed you just updated rules for public decorum and public participation I mentioned the indoor temporary mask mandate through at least
225January 15th uh and then um just wanted to call your attention to the fact that the statute uh indicates that a resolution of this nature is only good for 30 days um so today is December 15 this resolution would be good until January 14th um uh so that would cover our uh upcoming board Workshop uh but our next regular meeting is on January 19th uh so depending on how you vote on this resolution this evening uh we may need to have a special meeting in advance of January 19th to extend this resolution if it's approved tonight um so uh again our process board questions followed by public comment um the staff's recommendation tonight is to discuss whether or not to approve the resolution if you do approve it um um all meetings until January 14th
226will be held virtually in order to hold the January 19th meeting virtually we would need to pass another resolution in advance of that um if this resolution is not approved or if there's no action taken then we would return to an in-person format um if we return to an inperson format at any time in the future if the public health situation changes uh you could have a meeting to consider a new resolution so just wanted to kind of lay it out um and I'll stop uh for questions thank you Dr Churchill trustees do you have any questions Mr Pearson then miss Rollings Dr Churchill uh do we have any report from the city on the vaccination rate in Carl's Bad um so I don't have a report from the city I know that th that
227information is publicly available on the Count's website that I referenced um uh if uh uh you know give me a little bit of time and I could pull that together um certainly if that's the sort of information you'd like to be included in future reports uh you let me know in advance I'm happy to try to pull it together Miss Rollins um in the event that uh this resolution did not pass and we went back to uh with the protocols that were just uh passed and there was a board member or part of cabinet that was exhibiting symptoms Andor needed to quarantine would there be accommodations made and if so what would those accommodations look like um excellent question it's uh not one that I'm prepared to answer this evening uh but but I appreciate
228the question and and staff would have to uh let us go back and have a discussion about that H Dr Churchill if this resolution passes would it still be possible to meet Outdoors for the board workshop on January 12th and if so if the weather didn't cooperate could we cancel it and if if you also think that that would be something that would be doable what time would you recommend okay uh so I'll try to take those in order uh first the uh so this uh uh resolution that you're approving this evening does specifically call out uh the safety of indoor uh public meetings so uh you could approve this resolution this evening um and uh then subsequently decide to hold a meeting Outdoors uh so it wouldn't be subject to this resolution so one
229yes uh we have a governance Workshop coming up on January 12th and that could be held outdoors and we'd not be subject to the the same situation because the rules Outdoors are different than the rules Outdoors so yes uh number two um you know we would be required via the brown act to agendize that meeting 72 hours in advance um I I do believe uh I don't have it handy but but I I'm I'm confident there's a provision for cancelling a meeting uh so so certainly yes we we'd have the opportunity we'd have to you know let the public know that we were cancelling um and and to be rescheduled at a future day but yes we could do that in the case of inclement inclement weather uh your third question about the time you
230know I'd have to recommend that we start as early as possible just to have daylight um I I I think that an outdoor meeting meeting presents some challenges um it's doable but you know if we could start at 3:00 for example that would give us the opportunity I think before it got dark to accomplish our business thank you any other questions uh Miss Rollins yes so just to be clear if we agendized the meeting for outdoors and decided to do it virtually does it need to be cancelled and re posted or um is that just a change of venue and that could uh stay as posted that's a great question I hadn't considered cancelling it and moving it to a virtual setting um so let me look into that uh but I'd have to research
231the rules on whether or not it would be a change of venue and if it would be that simple I'm not sure but possibly yes Miss Williams thank you and I don't know if this question was similar to what um trusty Rollin was mentioning so if someone does have not feeling under the weather and can't attend in person is it an option to have an in to have a zoom just for that specific person I don't again I'm gonna have to research this I I don't think so I think the intent of the the brown act flexibility is when when we determine that there's a uh state of emergency and county or state public health officials have recommended uh distancing or other measures to combat the spread of Corona virus I think we allowed to
232meet virtually um I don't believe the intent of ab 361 is to to allow some members to come to a meeting and others to not um so I'd have to go back and double check um pre pandemic what were the rules on a trustee who was ill and not able to attend a meeting um there may be some vision of the a trustee being able to attend via telephone but um the brown act requires that the the location of that trustee be published um in advance of the meeting and that members of the public have the opportunity to to provide public comment at that address so um I don't think it's designed for a a trustee who you know Falls ill for example in that case trusty may just need to miss the meeting but
233I'll research it thank you thank you um now is the time for public comment on this agenda item Miss Garcia please call for public comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star n to indicate you wish to speak to this item and we do not have any callers for this item okay um may I have a motion to approve resolution number 24 2122 continuing Board of Trustees authority to hold virtual meetings pursuant to AB 361 as presented so so Rollings second Jones Miss Rollings uh made the motion and it was seconded by uh truste Jones trustees do you have any comments um I'll just go I'll start I I support the resolution
234I would like to hold the board Workshop outside on January 12th if the rest of you would be willing to do that um and uh from Dr Churchill had indicated maybe if we hold it from three to five um he had uh if that's I believe that the nature of the board Workshop that that Dr Churchill and I have discussed would work well in person and not virtual and so if we would not be holding it in person on the um the 12th we probably would schedule it for later on um but I anyway Mr Pearson you have your hand up as it is our custom if you're going to vote no for motion or resolution is reason why and I will not be supporting this resolution I think it's time to have our meetings
235in person uh we we just voted on updated procedures for public participation that has the same kind of protocol almost the same except for I guess the filtration as our students have to in the classroom our teachers in the classroom our administrators our volunteers and I think it's time we hold our meetings in person and give opportunities uh with these with these protocols safety protocols for uh uh for anybody who wants to attend our meeting as well so I'll be voting not thank you Mr Pearson uh and I guess before we proceed I could could we uh trustees could you show by thumbs if you are would be willing to hold a the board Workshop Outdoors on January 12th so my question is about that for the discussion okay so I I guess how will
236the live streaming and the and the phone Callin for participation work for an outdoor board meeting board workshops typically are not televised there there's there's no live stream so that would not be um so just like any other the workshops we've had in the past if someone wanted to participate they would need to come in person outdoors I I just thought we Chang the policy so that we're live streaming every meeting and having the ability for people to call in yeah as far the the yeah a governance Workshop uh we're going to be the plan is to divide into small groups and to do some some actual Workshop type activities so this one would not really lend itself to um to being live streamed than so um if you could indicate if you're willing to
237do an outdoor uh board meeting on the 12th um I'm a maybe I'm a maybe just because I um I'm not sure of my availability at three o'clock if that's the time frame yeah I get but I would be willing to do it um if we had more um uh the procedures in place like where we're going to meet the time all of that I would be able to uh give a definitive vote okay all right thank you and Miss Williams you indicated yes um Miss Jones did you did you show a thumb okay yes and Mr Pearson you're a no okay could you share why why you're not interested in having an outdoor meeting uh I think there's too many variables with weather I think uh coldness weather I think power um you know
238there's too many unknowns and plus it it'd be probably falling back on what I said at first is I hold this time to meeting okay got it okay thank thank you all right so the the motion on the floor is to um approve resolution number 24 um it looks like four people are probably willing to hold a a board workshop and I guess Mr Pearson I hate to put you on the spot would you attend the board Workshop I know that you would be voting against it would you attend it if we hold it outoors yeah okay all right okay good thank you all right um Miss Garcia would you please call for a vote on the resolution oh wait so sorry Miss Rollins were you about to say something yeah I'm just again trying
239to clarify so we're just voting on The Resolution we're not I I haven't amended it so I'm assuming that it's straight up resolution okay correct correct Miss Garcia would you please call for a vote on the resolution trusty Jones yes trusty Williams yes trusty Rawlings yes trusty Pearson no trusty Williamson yes that passes four to one we now move to item um are we okay to keep moving forward it's 9:17 C can I uh verify something okay um we and I know we just went past it but we had talked about outdoors and then we've just voted in favor of a virtual meeting resolution so I'm confused on what are the next steps Dr Churchill could you repeat what you had um answered into my regarding the question that I had asked yeah so so
240um you know in the in the body of the resolution I'm G to pull it up here so I can read it correctly uh you know um it it specifically references the indoor setting of meeting facilities as a as a rationale for approving the resolution which you just approved um in the case of a workshop which is wholly different than a regular meeting of the Board of Trustees uh you can meet outside and uh conduct the business of the board at that board Workshop um and and I think you know work around the resolution so I think um I'm comfortable and this is what I told president Williamson prior to the meeting I am comfortable uh with the board approving this resolution to hold regular meetings of the Board of Trustees virtually um uh because
241we can't meet indoors right now uh as the board just voted but if we wanted to meet outside for something like this I think it would be um allowable but there would need to be a vote of the board officially to do that correct and discussion on whether we would do that or not well I think trusty As I understood it trusty Williamson asked for consensus to to um try to schedule the January 12th Workshop outdoors and so staff would be working on that to to get it schedule as such okay so if we can um move on to item 9.6 2022 csba delegate assembly candidate nomination this is a discussion action item Dr Churchill thank you um I think this one I'm sorry now everything just froze on my computer Compu I think this
242one is uh pretty straightforward um every year csba delegate assembly um has sorry let me restart here this agenda item is seeking board approval to nominate uh trustee claudian Jones for the 2022 csba delegate assembly you'll see uh the materials in exhibit a a delegate assembly members serve a two-year term trusty Jones has been a delegate assembly member for the past seven years um your action tonight would be simply to uh nominate her to be on the ballot uh for the upcoming election for csba delegate assembly which occurs in March or April March I believe I should have asked trusty Jones to give that presentation you did it perfectly thank you trustees do you have any questions now is the time for public public comment on this agenda item Miss Garcia please call for public
243comment if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star n to indicate you wish to speak on this item and we have no callers for this item thank you may I have a motion to approve the nomination of trustee Claudine Jones to serve as a candidate on the 2022 California Schoolboard Association delegate assembly so Pearson second Williams truste Pearson made the motion trustey William seconded the motion is there any discussion Miss Garcia please call for a vote trusty Jones yes trusty Williams yes sorry trusty Rawlings yes trusty Pearson yes trusty Williamson yes that passed unanimously thank you Miss Jones for your service on the csba delegate assembly and hopefully you'll be there even longer
244for your nominations I appreciate it thank you we will now move on to part agenda item 10 governance team reports and requests are there any governance team reports are there any requests wait I had a report sorry oh I'm sorry did I miss your can you not see my hand oh sorry I I thought I I don't know if it shows up it's showing up on my screen but if it doesn't on yours I I apologize I should have just raised my hand yeah okay um yes please go ahead Miss Jones so um as mentioned earlier I am your delegate representative for sdcba and on November 30th and December 1st I had the pleasure of attending the first in-person meeting of cba's delegate assembly in San Diego there were officer elections updates and recommendations to
245vote on from the Statewide Tri anual governance study review for csba and delegate assem uh assembly we were provided an overview of the upcoming legislative session with details of what may come uh the education legal Alliance provided quite an extensive overview of the number of cases winding their way through the judicial system both federal and state that will impact educ ER that could impact education with topics uh ranging from special education and education funding to Public Health requirements and er uh I will provide a folder of the presentations we received to staff to share with the rest of you in an upcoming weekly report secondly I just wanted to share that I had an opportunity to attend the final meeting of the review team at Val for their visit uh for schools to watch the
246students staff and administration did an incredibly comprehensive Ive job and we will be eagerly awaiting the results for principal Johnston and the valley team uh from schools to watch and those are my reports thank you very much uh are there any requests I have two requests the first one is um and I hadn't realized it until tonight the hands that are being raised in during this meeting are right next to the sun on the logo on our back ground slides and so I think that I might be missing seeing the hand so I'm wondering can we and I don't know if it's that way on everyone's monitor but it is on mine is there a way that we could move the logo to the right hand side so the hand will stand out more okay

248specifics of the testing how it would be monitored any related costs I did share this request with Dr Churchill and Mr Grove several days ago and they said they are prepared to put together this plan if a board majority indicates their support again it would be for Board review and discussion so if you are willing to support that request if you could um indicate so by the show of your thumbs I see one I have a question yes um Dr Trill how much staff time would it take to put together um uh to put this together and um do we have any indication of what it would yield as far as numbers of volunteers being eligible um so so I'm a little bit um reticent to answer anything other than the how long will it
249take because this was not agendized and so I feel like we're running the risk of getting into discussion but um I would defer to Mr Grove uh I know he's been patiently waiting for an opportunity to participate in this meeting uh so Mr Grove what do you think in terms of time and and be brief uh well the the to be frank there's a parent who has been eagerly awaiting an opportunity to provide assistance in this regard and she has proposed a plan already to us so I don't think it would you know take much more than a half hour or so to develop the plan there's a number of questions that would need to be addressed at the next meeting uh if this were agendized but in terms of Staff time and leadup for
