018and safe Thanksgiving holiday thank you for your time and for supporting the Carl PTA thank you our next caller is 5555 good even hello yes goad good evening my name is Rachel Marino I'm a teacher at Sage Creek and a mother of two students in the district today I'm calling in my role as Cuda president I was hoping to have had this conversation with all the trust you separately but only one School Board member responded to my last email it was and is my hope that we can work together to the benefit of the whole District but I suppose I will need to use this venue to communicate with you I want to take this opportunity to remind you of a situation that's still persists teachers are in small rooms with children for 7 and
019a half hours a day some of us spend a prolonged period of time indoors with as many as 1 15 different students students who come to school sick and are sent home to test positive students whose parents are responsible in testing with the first sign of illness these students are both symptomatic and asymptomatic unvaccinated and fully vaccinated with breakthrough cases for sixth and seventh grade Camp despite the requirement to test before they go middle schoolers are still ending up at Camp Marston with asymptomatic covid it's not a reach to say that they are in our classrooms as well and yet the district persists in viewing teachers who contract CO as having had a choice that only irresponsible behavior on the part of the teacher could have led to an infection this is not the way
020to treat adults who continue to Bear The Lion Share of helping students recover from traumas learning how to be responsible me members of society and filling in the inevitable gaps they in their learning brought on by circumstances outside anyone's control we don't deserve to lose regular sick leave and irregular year when we have to stay home waiting for a test result and we don't deserve to lose sick leave when we contract Co through the risks that our profession demands of us I know you have heard from other teachers in the past few days and I hope you realize how important this issue is for us I ask that you make the right choice to support teachers thank you thank you our next caller is uh and press star six to unmute we are unmuted yes
021Madam chair may I please the board JB Scranton San Diego's number one sub and foster parent and I do not reside in the district I have two children California Public Schools Madame chair in our last hour together I indicated that we would spend some time this evening on the district's handling of the Pacific Rim incident as promised we'll be spending the next three minutes revisiting the darkest chapter in Carl's bad's history as a refresher you will recall that a jury rendered a $4.5 million verdict against Carl's Bad in 2012 of this verdict $4.1 million was just for exemplary damages Charles bads was 40% to blame which puts the district's share at roughly $1.6 million for its intentional misconduct this verdict was upheld on appeal exemplary damages are unusual and extraordinary they're not awarded in accident
022cases but only in those situations where a defendant's conduct was deliberate and egregious they're also called punitive Gam damages because they're intended to punish the malfeasant rather than to compensate the victim in the Years leading up to the Pacific Rim lawsuit Carl's Bad management engaged in an egregious course of conduct intended to deflect responsibility to avoid telling the truth Stonewall and avoid owing not to its responsibility this is relevant to us here tonight because the management of Carl's Bad unified has not learned its lesson from the Pacific Rim litigation Carl's Bad principles still mishandle conflicts at school sites and seek to deflect responsibility away from themselves and the school district and thehr director currently RI Groves continues to refuse to tell the truth when prompted with requests for information Carl bad's management has created a
023toxic environment and remained stubborn and entrenched in efforts to cover its backside Carl bad will be faced with another crisis in the future we all hope and pray it's nothing like what happened at Pacific Rim but it might be something like a me too type incident or a misoo a misappropriation of funds like a Poway or Sweet Water or something else entirely what we can be sure of is that Carl's Bad management will mishandle it and act only to save their own necks what will be different is that the punitive damage award Levy to Carl's Brad next time will have another zero attached to it that's because this board has received knowledge about the incompetence in toxicity of its management and yet has done nothing to correct matters there is a cancer on Carl's Bad
024unified good evening thank you our next caller is hi my name's Chris weidick I have two well one current student in the district and one that'll beia student in the district next year um I understand that a lot of the incident that occurred at stage Creek on September 15 um involving the the racial slur that was thrown at a student was likely discussed on the last um board meeting so I don't want to rehash that too much however my understanding is is that there was still um incidences at Sage Creek on October 22nd at Valley Middle School on October 25th and at CHS on October 26th where there were men with sign in front of the school approaching um pre-teen and and teenage students um and really what I asked from the board here I
025did hear a little bit of talk about the safety of our students um but it's concerning I mean the let them breathe um movement invited U these folks that came on 9 9:15 um to Sage Creek and they've disavowed that and claimed that they didn't bring them on but the fact remains that now these folks are here and they they seem to be intent on being visible outside of our schools and it creates a safety issue and that's really my concern is the safety of our students um so that's really the only issue I wanted to raise today and just want want the board to think about the safety of our students thank you thank you the next caller is 1732 hello this is Kelly leeron Carl's bed resident on October 26 carlbad city council
026held a special meeting with several local school board superintendents including Carl's bed unified one topic was diversity equity and inclusion there is an effort by some to distinguish diversity equity and inclusion from critical race Theory however one has only to view the slides from Equity training materials carlbad is using to train their staff to see clearly that the equity training is absolutely part of is the divisive and racist critical race Paradigm Chris rufo explains Equity this way Equity sounds non-threatening and is easily confused with the American principle of equality but the distinction is important equality the principle proclaimed in the Declaration of Independence defended in the Civil War the 14th and 15th amendments and Civil Rights Act of 64 is explicit rejected by critical race theorists to them equality is quote camouflage for white supremacy
027patriarchy and oppression in contrast to equality Equity as defined and promoted by critical race theorists is little more than reformulated Marxism in the name of equity a UCLA Professor proposed suspending private property rights seizing land and wealth and redis Distributing them along racial lines ibram kendi proposed the creation of a federal department of anti-racism it would be unaccountable to the elected branches of government and would have the power to veto any law at any level of government and curtail the speech of anyone deemed insufficiently anti-racist according to kendi in order to truly be anti-ra bis you also have to truly be anti- capitalist and to diversity diversity is generally good all things being equal but it is of secondary value we should be talking about and aiming at Excellence a common standard that challenges people
028of all backgrounds to achieve their potential on the scale of desirable ends Excellence beats diversity every time parents must come to realize that diversity Equity inclusion is a trojan horse used to usher in racis racist divisive and anti-christian anti-American ideas not meant to educate our children but to indoctrinate them into believing hateful things about our country being systemically racist and believing hateful things about themselves based on immutable characteristics like their own skin color thank you our next Coler is 1681 star six to unmute thank you good evening this is Katie Taylor can you hear me now hello yes oh okay apologize this is Katie Taylor uh my grandchildren are in Carl's B Unified School District and I've been a business owner in Carl's bed for going on over 40 years I'm going to start by
029reading my remarks presented to the carbed city council meeting yesterday regarding the school board meeting of October 26 on October 26 council members Patel and aosta participa in a joint Zoom meeting with the Carl rad Unified School District board and superintendent Churchill the key topic of conversation for me was CRI race Theory materials and educational instruction for carlb school the majority of the written comments submitted that people calling in to speak stay their clear opposition to critical race series diversity equity and inclusion ethnic studies Etc as it promotes and teaches racism bigotry and hate the very ideology parents and concerned citizens all over the country are telling their school districts loud and clear they do not approve or want this unacceptable ideology in their schools Californians for equal rights steeper has given Carl fed Unified
030School District their lowest score zero for their lack of transparency and their instructional materials promoting yes critical race Theory both council members Patel and aosta gave their gushing approval and support for these divisive teaching materials both council members use their own race and ethnicity to promote their position as I said at the school board meeting I'm staying here today no one earned any points or demerits for their race gender color or national origin people earn points and respect in life by their own qualities and actions how your life supports and helps your family and Community simply put by your own character and deeds I request council members to tell in the Costa stop trying to earn credit for something have nothing to do with their race gender and national origin I suggest everyone in the
031city council consider the strong message sent by voters in Virginia on November 2nd the people are taking back their schools taking back their city councils and taking back their state while the main catalyst driving the voter turnout rejection critical race the rejection of the false flag of equity and rejection promoted and created by these Concepts so council member Patel wanted to correct the record at the end of the council meeting say that she never brought up critical race the of course not as this school board and council members Patel High behind the euphemism of diversity equity and inclusion now superintendent Churchill and board members let me make it perfectly clear this school board and Carl's Bad council members patala Costa know exactly what myself and other speakers are referring to we call out curriculum for
032what it is critical race Theory you cannot hide the truth behind the euphemism of diversity Equity inclusion this is Marxist brain waram our children promoting racism hate and divisiveness I will not stop I will not stop pointing out the truth behind these corrosive instructural materials not the threat of being labeled a domestic terrorist by the FBI not by the radical teachers unions and not by this school board no one will silence my opinion thank you Dr Church it appears we've lost the caller uh she said thank you and concluded her remarks I believe I did thank you I apologize I had a technical glitch uh can you hear me yes I just want to make sure I apologize um our next caller is hello can you hear me yes thank you good evening my name
033is Jen weights and I'm not a carlstead resident but I am a proud Carl sad teacher I teach at Jefferson Elementary a title one school which means 40% or more of our students come from socioeconomically disadvantaged backgrounds for us it's about 50% lately it seems like the Greater carbag Community has moved on from covid or would like to and they are ready to resume business as usual in our population we are still very much in the midst of the pandemic and our small community is supporting each other through it in incredible ways but we could use more support aside from the virus itself which has taken family members for many of our youngest students there are very real and Lasting traumas some of our kids are experiencing as a result of the ongoing pandemic some
034of our families were thrown into or sunk further into poverty since last March which of course created stress in the homes and sadly LED some to substance abuse domestic violence or crime which our students witnessed a child in trauma cannot learn and our jobs as their Educators have gotten significantly more complicated as we navigate the complex social emotional needs of these and all Co kids please be supportive of all your carlbad students and remember when making funding decisions that equality is giving everyone the same thing whereas Equity is giving everyone what they need to be successful can Carl's Bad Unified School District do better to be a shining example of equity one of the unexpected Silver Linings I've seen in our district since Co hit is the addition of school counselors at the elementary level
035LEL we have added a spectacular counselor at our school but she is only at Jefferson half the time as she is assigned to another and um more accellent school as well she does not have enough hours in her two and a half days a week here to service our multitude of families that need her please consider how providing a full-time counselor at a school with more Young At Risk kids than anywhere else in the district could help give every carlbad student access to the exceptional education they deserve thank you thank you our next caller is 5658 hello um can everyone hear me yes thank you um my name is Katherine I'm a parent of two students at Jefferson Elementary I did want to briefly Echo the concerns of some of the previous speakers including Miss
036weights who just spoke um and also um one of the speakers who spoke much earlier in regards to teachers awaiting covid test results um I understand that they're being required to um go without pay during that waiting period and um as a parent I I do hate to hear that um and would request that they be able to um be paid for that time in addition um I'd like to request that class sizes be reduced the current class sizes um and averages in the current climate are just too large given what we're up against as a society we respectfully request that class sizes be reduced and that increased access to counseling services be provided to students this is necessary so that teachers can dedicate their attention to teaching and to Bringing kids up from any
037learning loss sustained over the course of the past two years rather than being focused on confidently managing classroom behavioral issues and disruptions after at least a year of virtual learning and some for some even more than that we're all just learning to be normal people again adults included we're all trying to figure out how to behave normally in Social settings and public settings this is especially true for kids many of whom were in a completely virtual setting last year and lacked even basic social and public interactions for an extended period of time when you couple that with the factors that Miss weights just discussed including um some uh poverty issues and in addition um food insecurity um Trauma from covid loss um you're just making a really big problem for children we're seeing this um
038play out in school especially at the elementary school level where children in public behavior is still a developing um or where where social and public behavior is still a developing skill even in the absence of a pandemic two ways we can mitigate this issue is by reducing class sizes and also increasing access to school Counseling Services it's imper during this time in particular that we do everything we can to make up for the past two years of learning loss by dedicating our resources accordingly first and foremost to the education of our children not to managing behavior issues that have been exacerbated by the pandemic that just simply shouldn't be a burden that's falling to our teachers it should be one that's distributed to qualified mental health professionals thank you thank you this brings us to
039the end of public comment on non- agendized items and on to item 6.1 approval of the consent calendar all matters listed on the consent calendar are considered by the board to be routine and will be enacted by the board in one motion there will be no discussion on these items prior to the time the board votes on the motion unless members of the board staff or the public request specific items to be discussed and or removed from the consent calendar if any member of the public wishes to provide public comment on any of the consent calendar items now is the time to do so if you are on the line please press star N9 to indicate you'd wish to speak to this item I see that one caller has indicated they'd like to speak to

044a few slight grammatical improvements that we made between uh the last draft that you saw on this Draft today so we're happy to answer any questions and uh we look forward to uh moving forward with the plan trustees are there any questions for staff and so I just wanted to confirm Dr n there were no other changes besides Ides grammar to the CTE final draft that is correct thank you seeing that there are no questions for staff uh if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the line press star9 to indicate you wish to speak to this item there are no callers that have indic ated they'd like to speak to this item uh may I have
045a motion to approve the career Pathways uh trusty Rawlings H I'm sorry I was waiting for discussion my apologies okay so move Pearson thank you trusty Pearson U may I have a second second rolls okay a motion by trusty Pearson and I heard trusty Williamson eek you out trusty Rings uh board discussion trusty Rawlings I just want to thank staff for all of their work on uh the career Pathways this has been a long time coming we've been working on it for quite a while and um I have to tell you I've had uh multiple um trustees ask me about our strategic plan for uh uh CTE so I do believe that we may see uh several more of these strategic plans and what they've said is that it's a great way to keep you
046on track and to keep you obtaining reaching for your goals and not just going year to year and kind of starting over so um it's very impressive and I think we're uh setting a precedent uh at least within North County and maybe even San Diego County thank you trusty Rollings and I'll Echo those sentiments and just say that I'm excited because this organized format also provides staff uh an easy platform hopefully easier more organized platform to apply for state grants and and additional funding that will help us grow the program so thank you uh Miss Marsh and and director arus Dr nine everybody on the team we appreciate the work you've done trustee Williams I just wanted to Echo those remarks and then um it was great working with um with Dr NY and on
047the subcommittee um to develop this so thank you appreciate it thanks everyone any additional comments seeing that there's that's the end of discussion Miss Garcia will you please call for a vote trusty Williams yes trusty rowlings yes trusty Pearson yes trusty Williamson an enthusiastic yes trusty Jones yes enthusiastic as well thank you so much everyone this brings us to item 7.2 educator Effectiveness funds expenditure plan if any member of the public wishes to provide public comment on this agenda item the time to do so will be following staff's presentation and before the board's deliberation if you are on the line press star n to indicate you wish to speak on this item I'll call for speakers again following the staff's presentation and we'll let uh we'll let you know when it is your time to
048speak trustees this is an information discussion item I'll turn it over now to uh Mr Rick Grove thank you excuse me thank you and good evening Carl's Unified School District was recently awarded a little over $2.2 million in educator Effectiveness funds these funds may be used to provide professional development for certificated teachers administrators paraprofessionals and certificated staff in 10 broad categories and the funds may be spent over the next several years through June 30th 2026 uh this plan is a bones Bare Bones plan uh we divided it up relatively equally over each of the years with 100,000 this year and the balance divided over the next four years 547 th000 in change each year now staff will develop detailed professional development budgets and plans for each EF year as part of the annual budget adoption
049uh that will give us an opportunity to consult with our stakeholders and involve Cuda in the collaborative process that we always do as well as Luna our classified unit this would come back to you for approval at your next meeting which is the requirement of the grant there is no template for the plan so this is U this is a placeholder essentially happy to answer any questions as are my colleagues trusty's any questions so I had a quick question Mr Grove on this one if staff determines a need for greater or fewer funds I guess so that the number would be different in the um following year will will that item be brought back to the board or is that a discretionary uh as part of the annual budget adoption process a more detailed plan
050will be presented to you annually yes okay great thank you any other questions trustees trusty Pearson Mr Grove um what do we what should we expect on impacts from this grant processes and what will be visible that's an excellent question you know in as much as we just received uh the Grant and have not had a chance to you know put a more detailed plan together it's difficult to State what the outcomes are obviously the intent is to improve employee performance and the outcome we look for is enhance student achievement but we'll bring those details to you each year with the uh the budget process truste Rawlings and I just wanted to clarify that at least for now the um uh the intent is not to increase professional days but to improve on current professional
051development days is that correct I don't know that I could just tell you that there is a specific intent yet what we've done is divided the funds over the each year to give us an opportunity to develop plans for each of those years we haven't really had an opportunity internally to contemplate what it may look like the funds came to us last month after the last board meeting uh we awaited a template which never was presented and our timeline was such that we have to present it to you as a plan in one meeting and approve it at the subsequent meeting prior to the end of December so um this is about as good as we can do on the short order um fortunately we've only allocated $100,000 for the balance of this year we'll
052get to work on determining what the best uses for that and then you know more than a half million dollars each year after that but as we always do Dr NY and his team always collaborate with our our partners our labor Partners to determine what the best needs are and director Austin would be involved in that process as well in the classified side thank you trusty Williams thank you trusty jnes um and I just have a question for Mr Gro is it specifically or directly for professional learning or is there any increase of hours for students for need or is that a separate po specifically for professional development for thank you thank you any other questions for staff trusty Williams your hand is up still okay seeing that there are no more questions for staff
053if any member of the public wishes to provide public comment on the educator Effectiveness funds expenditure plan now is the time to do so if you are on the line please press star 9 to indicate you wish to speak on the S uh we have no callers indicating they'd like to speak to this item uh trustees now is the time for discussion seeing that there's no discussion uh thank you Mr Grove this will bring us to item 7.3 Bond program monthly update again if any member of the public wishes to provide public comment on this agenda item the time to do so will be following staff's presentation and before the board's deliberation if you are online on the line press star9 to indicate you wish to speak on this item I'll call for speakers again
054following the staff's presentation and we'll let you know when it is your time to speak trustees this is also an information discussion item and for this I'll turn it over to Mr Dill thank you president Jones and good evening trustees I have uh a very brief update this month on what's going on with our bond program sure I'm in the right screen here always lags the first time I did okay so what we're going to talk about tonight is just a quick update on the work that we're doing uh talk about the uh Finance status of our our impending uh sale of certificates participation uh and I'll speak a bit about our program management uh of our bond program and uh then the following agenda item will be the design overview of obious Oaks so
055I'll I'll stop at the end of program management uh for your discussion and any questions uh and then avara Oaks will be a separate item so project status uh if you've driven by Kelly Elementary you'll notice uh that we are out out of the ground on the uh multi-purpose room and kitchen expansion the SK steel skeleton uh of those buildings are going up and so you can actually now see the full outline of that building uh and I'll show you a couple photos uh on the next uh few slides uh but I did share some with you on Friday as well but the best way to look at it is to drive by the school looks great um we are still uh evaluating the cost impacts of the the um uh storm water and other
056water Improvement uh uh impacts that we will be doing later uh in the school year so as we uh zero in on the final engineering of of that uh we'll be working with our uh construction manager and contractors um to get uh the the final pricing on that um you know we do have uh the final cost on the um on the construction management uh delay costs uh by essentially being stalled during that period where we were waiting for the permits to resume work at Kelly um they did they did actually incur some costs I'll give kudos to U Mr Anderson who scrutinized uh uh those costs and the proposal very closely and there was a lot of back and forth uh till we got to the final negotiated price and that that showed up
057in the um the attachment to this item for the summary of cost proposals for Ericson Hall at at Kelly um at hope uh We've essentially uh uh finished the core of the campus and uh we're still in the process of waiting for the final approval on the storm water improvements at Hope and then we'll go through that same process I just described at Hope and work with our construction managers and uh management companies um and contractors to bid out that work and uh get a price for that additional scope of work that's required by the city of carlbad but we have we need to wait until the final plans are are finished and stamped uh before we can go through that process so and the good news is uh if you go by hope it
058looks like uh it looks like all the work is done you wouldn't know that that we still have an increment that's that remains to be done and once we do have the um final approval from the city Carl's Bad um then we'll work also on scheduling as well Mr Anderson is in in touch with the principal on what that might look like depending on when we get approval and when we might start that work um and with Magnolia really we're in that final uh closeout process at some point in the next uh month or so we hope to bring you the final uh notices of completion that we'll file with the county so it's it's really just mop-up type of work that we're doing at Magnolia uh so these uh are some FES these are
059actually old now these were two weeks old uh when when I attached these to the uh presentation but you can see example of uh of that steel workor that was a really tall crane uh that was flying in that steel and you can see that skeleton both for the multi-purpose room and uh also you can see where we've uh started uh working on that pad that will expand the kitchen at Kelly as well so financing update uh just we've been doing some work behind the scenes in preparation for the the upcoming sale of uh estimated not to exceed $31 million uh to be backed by the existing special taxes paid by uh residents in the uh Community facilities districts uh we submitted a a notice to the s San Diego County Office of Education of
060our intent to issue that debt also to the uh County of San Diego auditor Controllers Office so they're now in their review process of that and I've got some follow-up discussions with them next week at the next meeting uh we expect to bring all of the documents forward to the board for consideration and approval of the sale um and that will also involve the district educational facilities Corporation so that meeting that you have once a year as part of your organization will have an action item uh for that meeting as well uh because they are involved in the component of the issuance of this debt and I'll walk you through all of that in preparation as we get those documents ready so um so the board has a firm understanding of of what they're viewing
061uh prior to we as prior to us asking for your approval uh we'll do the uh the credit rating uh hopefully at the by the end of December and then that takes us into January and we would we would plan on that second week of January uh going out to Market with that sale we do have flexibility on the date so if we have any hiccups in the market uh we can calibrate those hiccups and and go out on the best day uh where we'll be competitive and get the best interest rates possible on that and so by the end of January we hope to be completely closed and then I'll come back to you with the official report on the results of the sale but don't worry I will tell you how we did
062before then um so just a program management update uh I I've had some communication uh with you all uh on a recommendation uh that I have to restore a position that we previously had in the district uh director of facility and construction management I've added the word planning so I call it the director of facility planning and construction management um this really is a necessity uh that I see um to have a person who is a member of Staff who will be uh involved with the long-term planning of our facilities within measure HH and also our other Capital uh projects so whether they're paid for out of developer fees or uh our community facilities districts and really having that Long View Beyond when we're done with measure HH of what will will our needs be
063in uh to align with our demographics um and shifting populations um and working with the uh city of carlbad following developer uh agreements and changes to the general plan that could cause uh some shifts uh within the density of the city um all sorts of things that um are a long-term need but also uh make this person our official representative to the city uh via liaison for say for example safe routes to school uh so we could get some more um say in those processes and working with the city to them to devote more dollars um towards uh Public Works around our schools that are not necessarily our projects um and just a myriad of existing duties so that person would be brought on board and would have responsibility over the entire Capital uh plan
064and construction program uh would can work with our construction management companies would be working with our Architects Engineers public agencies etc etc and uh you know and that would be paid for out of our Capital funds uh so it' be minimal impact uh to the general fund if any uh so earlier this evening the Personnel commission met and they considered some minor amendments to the existing uh job description and they did uh pass those uh changes to the job description so we're ready uh to begin recruitment I've spoken with director Austin uh and I think we're planning a timeline of a December recruitment with a January uh interview and hire as well so those would be some changes to the program but I think um you know that uh with the amount of work that
065we're doing and the ongoing need uh that we will have uh beyond our bond dollars uh to make sure that that we are uh have consistency and um parity across of our campuses and also responding to changes in our enrollment it it it will definitely be worth it so those were the ends of my comments and uh I'll hold there because the next item is the next item thank you Mr Dill uh trustees questions for staff uh trusty Pearson Mr deal on this new position um I'm a little skeptical I'll be honest with you Mr D um so if you can help me understand what's going to be different than now what what what should I see differently in our district and what is happening now in terms of managing our capital projects our our
066bond um our relationship with the city I mean what's going to be well you know I'll I'll some some of the things I'll talk about are you probably have more history on it than I do since you've been around much longer than I have all of you collectively um but we brought uh gafcon and PPC on to manage the construction of our projects and and I will say that they do a very good job of of Manning the con managing the construction um but one thing we don't have the capacity for is this long-term planning um you know working with the with the demographers following uh you know changes within the city on the you know proposed developments uh and then working with our um with our Architects as well um you know as an
067owner and as a representative of the district uh to make sure that we've got consistency and parity across our facilities master plan um and so I think we need more horsepower to do that and be more involved on the on the plan side of things and you know if we can do that you know I I believe that we've had a lot of discussions about our budget um and the funds that are available for the next three phases of of measure HH and I think um with with more Hands-On involvement and um and and more of an eye on the budget side of things which is really the planning and not the not the implementation side of things um you we can design I think better to within our resources you know so that's one
068thing that I I believe that that we will will see as a benefit and then the other thing is um you know just those other types of uh liaison activities you know that could benefit the school district um that you know when we when things pop up like safe routes to school and you know maybe we know about opportunities maybe we don't maybe we're participating maybe we aren't it' be a responsibility of that person another thing um that is a need in the district is we really don't have uh a good um sense of all of our classroom utilization districtwide and often we've got uh different programs fighting over a finite amount of space uh and to have somebody who uh has a thorough understanding of every classroom space and how it's currently being used
069and what are the opportunities uh and and what would be best suited uh in in the placement of different programs um so that we and so that we can be coordinated rather than um one program asked first so they get that classroom first well if we you know have a more structured view of our classroom utilization um you know whether it's when we think of things like the expansion of of transitional kindergarten the location of our preschool program the the best place for our special ed programs to be compared to where they live you know those are all things that a planning director does and right now we really don't have somebody who is a planning director in the district thank you Mr D thank you Mr Grove thank you yes I just wanted to
070provide per perhaps a little Clarity to the perception that this is a new position um some time ago prior to prop P we had an employee in an analogous position to this when he retired we geared up with gaathon and as prop P wound down we reduced the level of service that gaathon is providing and we once again filled this position and when that employee resigned and left the district it was prior to the beginning of prop HH um we've been working with a mix of services over the entire construction management timeline in the district and it's it's es and flows based on the the volume of work being done but this is really a vacant position currently not a new position and It just fits within the mix of services and how we provide
071these services with external contractor so um so that that's all yeah and and the other thing that that I would task this person to do is really look at all of the different funding sources that we have available and match the projects to the funding source um as I as I look back at some history you know I kind of wonder why we did some things the way that we did um and with the uh pending release of funds that we'll be bringing into the district you know those are cfd funds funds those aren't you know districtwide measure HH funds so those need to be used in a certain way you know we've been uh we've been amassing some developer fee funds that perhaps we could have been using for things that would be responding
072to growth uh in the district and so um you know this person would be looking at here's the pot of money it applies to this project and we can make most effective use of all of our Capital dollars that way and you know recently we've been looking mainly at at measure HH and um you know I I certainly um you know this is this is no criticism of uh of our construction manager um that we have now it's it's just a need that's that's not being met at this point Thank you any other questions for staff trustees okay seeing that there are no qu no further questions uh is this the end of this presentation Mr Dill correct okay um if any member of the public uh wishes to provide public comment on this agenda
073item the bond program monthly update now is the time to do so if you are on the line please press star 9 to indicate you wish to speak on this item there are no callers that have indicated they'd like to speak to this item trustees now is the time for discussion truste Rawlings thank you um I just wanted to say that I had the opportunity to go to hope uh Elementary at the end of October and uh the pictures do not do it justice it is fantastic it is absolutely beautiful worth all the long nights all the discussion all of the um work that we all did uh to make that happen and uh I was just so pleased and and the uh you could tell that the staff working on that campus were pleased
074as well and so their working environment improved dramatically so I was just thrilled to do that and I wanted to share so if you haven't had an opportunity to see hope I haven't been out to all the new ones yet either but if you haven't seen hope it's it's a it's quite magnificent thank you trusty Rings any other discussion okay seeing that there's no oh I see it okay seeing that there's no further discussion thank you Mr Dill this brings us to item 7.4 FMP Phase 2 modernization project uh final design Aviara Oaks Elementary School again if any member of the public wishes to provide uh public comment on this agenda item the time to do so will be following staff presentation and before board deliberation if you are on the line press star9 to
075indicate you wish to speak on this item I'll call for speakers again following the staff's presentation and we'll let you know when it is your time to speak trustees this is a discussion action item and I'll turn it again over to Mr Dill thank you again so let me share my [Music] screen so what we are considering tonight are the uh final schematic design so that we can go into design development uh with the ultimate goal of submitting to uh the division of State architect along with the city of carlb and and any other uh agency that that would need to be involved D in this in this upcoming project uh we'll we'll this is the end of a long process I know you've you've seen these and reviewed these a number of times and
076I would do want to thank the board for the discussion that we had uh back in September uh we took all of your comments and and thoughts suggestions and Direction and worked with Mr Prince who's here this evening who will will speak to some of the the changes that we've made um and we've been able to know bring this project much closer to where we uh originally envisioned that we would be in terms of the budget and still managing to do quite a bit and uh some a project that will be consistent with what we're currently doing at other elementary schools as well and we'll point that out along the way um so let make sure I'm in the right screen so just in in terms of a budget history um this has always been
077a schoolwide modernization plan uh at the Inception of uh meure HH we had an initial budget estimate of just under $20 million when we worked with staff and stakeholders uh and and went through the the design process um we ended up with a project that was you know much larger in scope and that was the result of that lengthy discussion that we had back in September and at the end of that discussion uh you the board gave direction to uh adopt all of the suggested refinements in the scope um that Mr Prince had developed as alternatives to help lower that budget um and then some so uh in addition to those and I'll remind you what those things you were in just a moment I add an an additional slide so you can see that
078um uh but we also removed that Center spine that is basically joining the elementary campus to the middle school campus and that's for future consideration so as we either have savings or available or get some efficiency between the two projects we can still consider doing that work but we've essentially pushed that off for now um and so the budget that you'll see in in one of the final slides now is much closer to where we began at at just over $21 million so when I look at the availability of funds from our community facilities District um some of the which uh were collected to apply towards the construction and expans ion of Aviara Oaks uh elementary and middle that's where we cover the Gap you know we've got those existing funds uh in above and
079beyond measure HH that we can apply to this project um you know if we if we can stick within that budget so this was the slide uh that you saw back in September um that Mr Prince had uh had pulled together of different options for construction savings and I know several trustees said I move that we do all of these things and so that was that was the the starting point on refining the scope and I'm just flashing this up there as a as a quick reminder and that was before we had the discussion of removing the MPR and the kitchen expansion ET and the library modernization Etc Mr Dill I'm sorry I'm I I don't mean to interrupt you but I'm not seeing any slide oh okay well I've been talking to nobody here
080uh no you're you're talking to us I we see you and the whole group Mr Prince as well welcome to to no thing I was talking to people but no thing I'm sorry uh no worries okay well you know and I saw one trustee move in and and look and I thought they were trying to read the small uh the small numbers so let me just back up a moment I'm sorry I I should have said something sooner I thought you were introducing the slides and then you were gonna show us so my apology I was I'm sorry I just made your evening longer um so this was the slide that I was speaking to of of where we started where we were a few months ago and and where we currently see the budget
081of of $21 million um I won't dwell on these things these were the scope refinement options that uh we presented back in September that was the starting point for you know some substantial revisions to the the concept of the design of of the school uh modernization project and then okay this is where this is where I was ready to go to my my next slide um these are the slides that that we always show I did update the current enrollment for avar Oaks this is as of last week um and this is I put P5 this is we've moved the preschool to avara or portion of the preschool program to Aviara Oaks uh since 2018 so now I'm encompassing that it's about 34 students right now uh and all in at 694 so just below
082that that projected enrollment and since we're speaking of projected enrollment we're we're currently working with our demographer on an updated demographic study um and when we get those results ultimately we'll be presenting those to the board but this is as of as of last year's projection so with this I turn it over to Mr Prince and he can walk you through the changes uh we we do have a before and after slide and then a final budget tally great thanks Eric um this is obviously this is the um proposed entry and what you see in the background in that kind of a darker gray section is a proposed classroom Edition um and we'll talk about that on when we start looking at the slides uh the site plan slides why we go to the next
083slide so this was the concept that we presented to the board on September 29th where we started to um identify the various buildings that have um what we have defined as a light modernization heavy modernization and new construction and just a remind everyone the light modernization is basically new lighting air conditioning finishes nothing really heavy structural and so the heavy modernizations is where we're going to be adding walls moving walls doing things that are a little bit more intense in that level and then new construction is obvious it would just be new construction so in this particular concept you'll see in the spine that we did have scope for adding to the kitchen and remodeling lay the kitchen at the multi-purpose building at the top and then moving over to the um right we also
084were're going to modernize the library going down into the kindergarten the 400s um we had planned for um a new classroom Edition with what was the projected growth in the area and um as well as modernizing the existing kindergarten building which is 400a 300 would be the um steam art and music building and that's still in in the process here six and 700 or five and 600 would be um light modernizations which is finishes and everything kind of cleaning up the new door new doors and windows things like that 7 and 800 we're doing it as a these are the modular buildings that are out there now we listing them as heavy modernization only because we have um drainage issues that we know about that um we're going to have to lift the um plywood
085up and put some um concrete underneath there what we call a rat slab to help with the drainage and so there is a little bit of structural work so we're going to although we're not moving walls we are going to be doing some structural work so that's why we've listed as a heavy modernization and then the new Modular Buildings so taking the recommendations that the board as you know the the list of potential scope reductions let's go to the next slide what we've done is kind of relooked at things and U like Mr D said we took out the upper spine where the multi-purpose building and administration all that's going to be taken out of the scope for right now um I think as we start to study the middle school and see how this
086works will um bring back a concept that may include some work in there um we are still going to kind to rework the parking lot along in the driveway approach because that's still a a major um issue that we need to resolve we're reworking the entry along that but we're going to also just plan for a future addition at the kindergarten area for right now because the classroom counts right now we're finding that um 33 classrooms including the preschool program does cover um all of the classroom needs for right now as well as some future growth so um we felt that that you know it's going to it's going to require us to be a little bit efficient so this was the way this was a big cost savings that we felt was um worth
087pursuing we are still doing the new um parking lot to the South and we're going to move the modular building still to this um to the 900s to this area because this is where we're going to put the kids CARE program and also have this be an early drop off era area which is also next to the playground area so the parents one of the complains they come on the parents have to walk across the site and drop their kids off this will make this a little bit more efficiently trying to get the traffic on and off the site as fast as possible we are planning on new storm water bio retention basins as well as reworking the hardscapes and um play fi as you see there we did reduce the overall Landscaping as one
088of the budgets so we're going going through and kind of tightening that up as we get into the process and as Mr Dill noticed when we were this um last week when we met as a team with um our Builders we actually started to break down the components really in detail and starting to really kind of what we call just peel the onion back and really start to to hone in the budget which takes us to the next slide so in that we were able to look at the design work with um Ericson Hall um through their pre-construction services and really kind of hone down the budget so what you see here is now what we feel what we believe is um a reasonable Target to get um meet the facility the spirit of the
089facility's master plan and to achieve the same level of care that we're doing elsewhere so that gives us a total construction budget including all of the general conditions bonds um there's a designing contingency in there and the reason why we we we dropped that as well is that um as Mr Dill saw we actually have modeled everything in in very de very detailed right now so I feel very comfortable that I know the amount of square footage for roofing and drywall and and felt comfortable with these numbers for right now so we're looking at a total construction budget of 17 million 336,000 and then using a uh 25% project soft cost gets us to the 21.3 just rounding it up and that's kind of how I we've taken everything that the board has asked for
090and I think we've massaged it nicely and have a pretty clear plan now um where to take the design and with that uh we will turn it over to uh discussion questions action hopefully thank you Mr D uh trustees any questions uh trustee Pearson uh I think this is for Steve Mr Prince um on the budget I was wondering if permitting was in general conditions and requirements uh no permitting would be part of the soft costs so those are the fees and the city fees great thank you thank you trusty Williams thank you uh so Ste uh Mr prince in the previous slide I want to trying to see which one five yeah where you have the thousands what was that for designed for where you have now the 900s move there was um throughout
091this process the the master plan showed uh up to uh 35 classrooms and through the design process for some reason it kept growing up to 44 classrooms and that's where we had the extra that's where we created the thousands was for this uh this anticipated growth but it wasn't really there so Eric and I spent a lot of time kind of literally going grade byg grade trying to figure out where this was and so that was a big reduction is that we really didn't need all those classrooms and so the thousands just kind of went went away to bring that because if you this slide if you if we go back I think it had 44 classrooms so we took out nine of them as part of that so basically the thousands go away okay
092so we're not misplacing anyone every but we did those we actually went to the site and got their site map and actually looked at who sits where and knows where the programs are and so um and I think not to you know I think to help with the board position you know with the director of facilities that's really it's going to help us because we're going to have to you know what's happened is that there's been classrooms that have been made available and there's been a little spread that always happens and so helping us kind of consolidate that really will get us here yeah and I was going to to jump in and say this is essentially a oneto one and uh and if I were to toggle between the the first iteration and the
093current one and you see the 900s up there and then the thousands it's more or less what this concept that we have now the difference being uh this 900s uh is new modular construction so you know consistent with say what we're doing at buav Vista we are you removing older uh Portables we're replacing them with newer modular construction um the beauty of of placing this down here is that while we are under modernization and construction we can keep the existing Portables you up on that pad that's now showing on this slide is 900 uh and use that if we need to move classrooms around while we're renovating um we've got the existing portable classroom space um to accommodate that uh and then you know at the end of the project we can either you know
094use those as uh as Portables on different campuses to to do the same thing uh or if suddenly we have a complete change in our enrollment project rections demographics and and students are showing up faster than we thought they would we've got additional room for uh expansion on the campus as well so those sorry can I follow up on that go ahead so so you're saying going back to this the the new revised Slide the 900s so all the 900s are modular they're not Portables and you're keeping the Portables where they're at in case you first space okay and the idea is we would keep them there through construction and then at the end of the project those would be removed and and we would end up with the same as what we had before
095because we've got the new pod of classrooms down in the 900s the new 900s okay that yeah that makes okay I have more questions but I'll wait uh go ahead actually thank you for asking that because that was going to be my question and that's perfect go ahead okay um in the I'm looking at the last one in the 400b which you now put future NIS is what does that mean is there any any students going to be in that building is it a holding spot I just I'm trying to understand what that means it's a holding spot so um if the demographics show a surge that there would be an increase um in kindergarten and potential TK um then what we're going to be doing is grading a pad and putting utilities there so
096that if the need does come up we can actually build the building there later on okay so NIS means not in scope so it's a it's an outline because it's a future potential spot for a building but currently not in the scope was there any sorry can I go ahead um truste Rawlings was your question related to that one it is but um I'd be fine for trusty Williams to go ahead thank you go ahead trusty Williams thank you I appreciate it um was there any discussion about possibly moving Administration in that area since it's more in line to a good location for it I know there was talks about and not in prop P about it I just wanted to know if there was discussion at all about that it's not out of the
097question if if if it makes sense from a classroom count standpoint it's a building pad so it can be right now it's it's earmarked for a um kindergarten and TK but if the enrollment never really supports that and an administration building does it makes complete sense and it's it we can size it to that okay thank you thank you trusty rowlings thank you um Mr Dill um uh would there be any um additional funds available uh as the state um increases its um um investment in TK for this type of work so there's not dedicated TK funds right now uh and there there's a very poultry amount uh that was allocated in the current state budget that covers all expansion planning maybe including facilities um but we received I think less than $200,000 districtwide for
098uh that planning effort for rolling out expanding TK in the in subsequent years so it it would not cover uh anything close to to putting a building in the other the other stipulation on that state funding that was allocated this year is that it could not be used for any relocatable classrooms so they barely gave us any money and then they said you you can't use it on on the most costeffective way to rapidly put in a building for to to address enrollment expansion uh so the I just gave a long answer to short question which is no there isn't um however um we are watching development in this upcoming legislative session uh assembly member O'Donnell has a a uh a state school bond measure that he's proposed um there's some negotiations with the state
099senate um we know that there will you know almost I'm almost 100% certain there will be a measure on the ballot and just organizations that I'm working with right now are uh talking to the legis to say if we do get something on the ballot for state school bond money make sure that TK is part of that um because every Elementary and unified district um is facing these costs any other questions trustees trustee Williams thank you um I have a in terms of flow of traffic is it the intent that I just just I understand that this is always flow traffic and know a in AOE and a is is big is the intent is there's not going to be if a parent has an AOE student and an a student they have two entrances
100to go through yeah that's kind of the idea right now we The Next Step that we need to you know we've done this is based on a theory and so we believe that this is the way to solve it there is a gate between the two sites that we still going to maintain so that at the top there so you know what we can do is as part of the study is what do you what happens when you have a parent that has kids on two sites do you do you create that an opening and do you you know do we have to bring a staff person to monitor who does this because obviously people will start to cheat if you if you create the opening um we have to we have to start getting
101a traffic engineer to start helping us kind of look at this um I was actually by the site this morning um and an interesting traffic flow that is now starting to introduce to school sites is all of these ebikes everywhere and these kids drive like they're driving motorcycles and so all the rules of stopping at crosswalks and doing the things you're supposed to do when we were taught that doesn't exist and so that's going to be an interesting traffic measure that we may have to look at I don't know if that's going to we'll have to get into that that's where we're we're wanting to seek approval for the site plan so we can start to engage at a more technical level to start analyzing these things I just want to make I appreciate that
102and I and I know about the situation with the ebikes and I don't know if and and the reason I'm asking is is if things are changed does that modify the budget so for instance if we have to expand the entrance to to allow a larger bike path to you know to accommodate that or right or the egress and ing just trying to figure out um is that GNA limit the budget do do you need a modification on that or is that gonna well if there if it does obviously we're not going to we're going to do everything we can to stay within the budget but if there is something that does that a study reveals and we do have to do this obvious then what we would do is we bring back to the
103board you know an explanation and presentation as to why we have to do this as of right now we believe in when we've shared this site plan with the city conceptually they they like the idea but they've also asked for those traffic studies to further discover the you know further understand the level of detail that's needed you know they may ask us to do light enhancements which we're obviously not going to just at first want to accept but you know that's part of the process of moving forward with the design so two follow-ups on that if that's okay trusty Jes let me uh check in with trusty Rawlings do you have your head hand up trusty Rawlings yes but she can go ahead thank you so long as it's around the traffic key it's all
104traffic okay so y so we discussed in in in length about Magnolia having a bike area do we have anything like that for and I don't see it that's why I'm asking for at this level um I haven't shown it but if if you point towards the front of the campus where it says future in that kind of new paved area up there is what we're looking at one of the things that's interesting right now because of the ebike phenomenum is is getting bicycle racks that actually can fit those fat tires and so um we're looking at that it's also going to take up a lot more area than we used to set aside for that so so again that's more of a design development detail that I got to start getting into and and
105but we've kind of internally basically where you see those four trees in the corner of the future that's kind of what I'm thinking is a space in that area is is a future bike storage area okay thank you and then my next question is is there going to be a pathway for people walking so maybe you'll see two Pathways you'll see one right there where Mr Dill's cursor is for those who are coming across the street and that way because Department of Ed doesn't want anybody crossing the driveway approaches so we put that switch back because there's a grade change there and then they'll come across the site and into the campus through the South and then for those who park on the street which we know you know we're not encouraging it but it's
106going to happen we have that other one where Mr Dill has the cursor on where they come down and go straight across and into the site that way and then is there another pathway connecting at the top where you saying about the gate where you'll see see along the the drive the driveway there's actually a concrete walkway that's going to go all around the perimeter right around the Inside Edge of that Hillside so parents could drop off if they're dropping off at AOE they could just drop off a student there at aom and they can walk okay exactly to reduce that okay perfect thank you and I just wanted to check in with trusty Williamson uh I know your hand features not there I I'm going to try and keep you on the screen but
107they the screen um pictures move so if there's any way that you could just unmute and let me know if I'm missing you thank you I actually figured out to do alt Y and I my hand was restored oh good so I'm back but thank you for checking in with me thank you okay trusty Rawlings yes thank you um I wanted to ask if um while you're doing traffic studies will you also be um uh considering the North County Transit study that is underway and potential uh pilot program I'm not familiar with that but we'll definitely bring that up with the Traffic Engineers as we start to engage in the process okay I don't see anyone else's hand up given that we are through trustee questions uh if any member of the public wishes to
108provide public comment on this agenda item The Phase 2 modernization project final design AAR Oaks Elementary School now is the time to do so if you are on the line please press star n to indicate you wish to speak to this item okay we have no callers indicating they'd like to speak on this item so uh trustees may I have a motion to approve the final design for aviar Oaks Elementary for submission to the division of the state architect uh ex as exhibit a go moved Williamson thank you and a second second Williams thank you so that was motion by trusty Williamson seconded by trust Williams uh for discussion truste Williamson thank you uh thank you for the presentation and for the adjustments that have been made my only concern is on the alternative or
109optional or the the the um buildings that you have not shaded that just the outlines that we understand what that means but I don't know that everybody else would and so our My Hope was that we that what we would be presenting would be would not have anything on there that the funds are would be covering so that that's just my thought thank you trusty Williams thank you I appreciate all the work and the modifications I really like the design um the thoughtfulness through it and it and it keeps the campus together and thinking about the restrooms and all that and then the playroom areas there the only thing I would and and and I know it's probably out of scope um is um and I don't know if the trustees have have comments about
110this is moving that administrative I know we've talked about it before in in previous years about having the administrated closer to the parking area so it's EAS better accessed accessed um and that's just uh I just wanted to throw that out there thank you trusty Williams trusty Rawlings um I I also appreciate the work that's been done and uh take into account our comments and I I want to um agree with uh trusty Williams I would I would lend a thumb to that I do believe that the administration building should be towards the front um due to safety as well as convenience so that I would want to see that as well if that's possible thank you trusty Williamson there there now my mouse is moving um we've had the discussion about moving the administration
111building and com and talked about it at length and that I think the board expressed their interest in that and then I think that it was cost it was a cost prohibitive concept which is why it it didn't happen and so I'm just a little bit concerned that at this point that we are going back to something that we had agreed to not go with so maybe I just need some clarification maybe from Steve if that's something that would be in the in the cost in the in the current budget not on the current budget it's actually the administration buildings are actually earmarked as a phase five project so it is something that can be considered but it would be at a later phase you know the nice thing is we have considered it as
112a building pad with utilities so it can it can be a administration building once we you know get there and if there's phase five dollars available we can actually you know plan for that and I would just chime in and agree with trusty Williamson and I think prioritizing the uh NPR which was student use because I think I've heard the board say multiple times that they would prioritize student use facilities before Administration and it was a difficult choice between the two obviously we wanted both but uh so thank you for reminding us trusty Lanson any other discussion trusty Rawlings what I was talking about was uh when trusty Williams was saying that and I think it was section four where the TK building was that we would and I'm assuming that's also in Phase five
113or am I wrong there that could potentially be a face five um you know at this point you know it's it's not going to be in the scope um it it you know we could look at that in any subsequent phase quite frankly you know any of the projects that we've identified from here through the end of measure HH you know it's always within the prerogative of the board and the district to move things around as they U as the situations evolve um but as of right now that would be future phase probably phase five unless suddenly we had an urgent need um you know and then we would either be looking at what available HH funds do we have or potentially developer fees if it was coming from new development and I guess that's
114where I was coming from was not necessarily prioritizing the admin building in the front there but the buildings that we have in the front that are phase five I would rather see those as the admin and then the TK be uh towards the back of the school that was what I was agreeing to I just want to clarify thank you any other board discussion okay seeing that there is no further discussion Miss Garcia will you please call for a vote student representative pekovich yes trusty Williams yes truste Rollings yes truste Pearson yes trusty Williamson yes trusty Jones yes thank you Mr Prince and Mr Dill we appreciate uh your help with this this will bring us have a nice evening Mr Prince uh this brings us to item 7.5 review and revision process for board
115policies and bylaws uh if any member of the public wishes to provide public comment on this agenda item the time to do so will be following staff's presentation and before board deliberation if you are on the line press star 9 to indicate you wish to speak on this item I'll call for speakers again following the staff's presentation and we'll let you know when it is your time to speak uh trustees this item is an information discussion item and for this I'll turn it over to Dr Churchill thank you very much uh we'll go through a few short slides here um and and while there's no formal action to be taken I will try to get consensus on a on a couple of items um from trustees so so we can move forward share my screen
116all right so um as you're aware the Board of Trustees is the legislative body uh which determines policy for the school district and then those policies are the written statements which express the will and intent of the board uh with regard to the operation of the district we use those policies then to to guide uh my office and and all of the staff uh in the day-to-day administration of the district uh you'll recall that our September meeting during governance team requests trusty Rawlings requested an agenda item to be placed uh on a future board meeting to discuss a mechanism for reviewing board policies prior to them coming to board meetings for approval uh and so that is this item um you're well aware districts are required to adopt specific policies and bylaws uh and we
117must ensure legal compliance with state of Federal mandates uh due to due to the passage of hundreds of new laws every year policy manuals and school districts can quickly become out of date we subscribe to the California school boards Association or cba's policy audit program uh and and they push out regular updates to board policies um those are recommendations there sample policies that they push out uh their legal team and compliance team make sure that their recommended sample policies are in alignment with all current law uh and so so uh we find the subscription of Great Value because uh we we don't have to do the legal research ourselves we we rely on csp's legal team to do that uh we have a board bylaw 9310 which currently um the current version states that the
118superintendent shall present drafts or suggestions for new policy and policy revisions when changes in law occur number one and number two when specific needs arise um what's interesting when you look at that particular board bylaw 9310 uh you can see here on the Le hand side it's just a screenshot of our policy uh it was adopted in 2006 and we've not revised the policy since 2006 uh in fact this is cba's screenshot of their most recent sample board policy uh and they they they um last reviewed it and and made a revision in 2018 so so there there's a a sample board policy there which is a couple of years old now um which uh we we can consider updating our policy to um there are uh a number of reasons why we haven't brought
119that to you yet uh we we've in fact we looked and looked at the last couple of years we've reviewed or revised 110 new Andor updated policies to to this board since the start of the 1920 school year 17 of those 110 policies were in fact updated twice uh due to csba revision um so so we've brought about 50 policies a year uh to this board for for um review or revision or adding as new uh when we we just did an audit of our policies uh and we found that there's an additional 216 which have either been revised uh or added by CBA which we've not brought to you and and that board bylaw 9310 is an example of one uh the policy is in line and up to date in terms of um
120any state or federal law um and so as we kind of have been triaging over the last few years the policies that we bring to you we focused specifically on the ones that had uh some legal ramifications and other policies like this one um just simply for from a Time standpoint uh we haven't gotten to yet um so and we'd like to remedy that that uh situation so so there's really a couple of proposals here um the first is uh when we look at those policies that come to us uh for review and revision because of a change to the law uh we we get regularly I'd say it's about five times a year um a bulletin from csba that includes um all the policies that have some some legal or other reason for updating
121and what what staff is recommending to the board is that um as csba recommends uh those changes uh we staff would compare our current policy to the updated version incorporate required changes and and then we'll bring it to the board uh twice once as a first reading uh at that first reading you've got time for members of the public to provide public comment which we we believe is an important part of the process uh that giv gives trustees the opportunity to ask questions give staff direction for additional changes Etc we would then at a subsequent meeting um uh bring those policies back as a second reading having made any changes as directed by the board um there's again public comment period uh and then following public comment questions and discussion we we'd ask you to
122approve the revised policy so we imagine doing that you know as we get board policy revisions from csba five times a year we imagine bringing a slate of policies to you five times a year following that and as it's a bifurcated process over the course of two months the the five revisions a year um ought to take 10 months and we ought to be able to stay current uh which which is um which is where we want to be now that doesn't help us get caught up um I mentioned those 216 policies that are uh that do have csba recommended change to it that we haven't looked at yet uh so staff is recommending for us to catch up uh that we do a couple of things one we'd like to form an ad hoc
123board subcommittee uh that board subcommittee would meet with staff to review the 216 policies that that have csba updates um we envision uh scheduling a meeting of the ad hoc board subcommittee in advance of the meeting uh sending out to all committee members so two trustees and a you know a number of Administrators from my team uh each Committee Member would get a packet of policies review csba language to our current policy and come prepared to to discuss those items that do require revision when we do meet um we'd like to move through as many policies in in one day as possible and if all the committee members come prepared I think we could do that pretty quickly uh at that meeting then staff would comp compile all of the recommendations and we'd like to
124bring um a slate of as many of these policies as possible to the full board for review and approval again uh using a two meeting process where we do a first reading of the Slate uh we uh just as we mentioned before uh time for public comment uh and and trusty questions because that would be the first time the full board would see all of this um and then we'd come back um another month for a second reading uh which is an addition opportunity for board questions additional opportunity for public comment uh which I have a typo there um and and then we'd be asking the board to approve as a slate the updated policies uh we think we could do this in a couple of rounds um and and so the ad hoc subcommittee
125would schedule additional meetings as needed uh and then then we' dissolve the committee because it's it's ad hoc in nature so that's our recommendation in terms of process um I just want to you know just just to be clear I think I covered this but um you know board bylaw 9310 does allow us to wave the second reading and and just approve policies in one swoop and and we've been doing that more over the last year or two um and and staff was was recommending that as a way to speed the process up um but but we we took a step back we looked at the practice and and staff does not currently recommend that we wave the second reading um we we'd really like to bring it as a first reading um if there's
126you know unanswered questions requests for revisions or whatever we'll we'll um bring it back for a second reading um but even if there aren't any revisions to be made we still think it's good practice to accept it as a first reading bring it back the next month as a second reading and and ask for approval then so uh in rare instances and you'll see it tonight later on the agenda uh something could be brought back for a third reading if necessary if if more time was needed so um not to belabor that uh the two-step process we think is important so um I'll stop here ask for board questions um and then obviously public comment uh and then when we get to the discussion um phase we we'll really be asking for consensus around a
127couple of things one consensus to form an ad hoc board subcommittee and who would like to be on it um two do you agree with our recommended process to catch up on those outstanding updates and three do you do you agree with our a process for doing ongoing updates as we receive them thank you Dr chill uh truste Rawlings thank you and thank you for putting this together I really appreciate it my hope is that it will streamline the process um but it does seem within the the agenda or in the slides that we're talking about some requirements and then some recommendations and one of the things that I've found um that I found problematic in our process is we were just taking the csba um language and then putting it up as the um
128changes so are you saying that you would just bring forward requirements to the board or to the ad hoc committee and then that would go through the process or would you be bringing forward similar to how we've done in the past where it's everything csba is recommending and or required um I I think our recommendation is um to give the board subcommittee uh here's our current policy uh sorry you can't here's our current policy here's the cba's current recommendation and let's take a look at it and and make determination whether or not uh our policy needs to be updated it's it's entirely possible that you review any number of our uh uh policies and bylaws and um you know make the recommendation that there's no changes uh and and we can indicate that in the
129gamut system that you know something was reviewed and and not changed I I think that's that's an important part of the process um because you're right some of the recommendations uh from csba may not be strictly uh based on changes in in state or federal law and so we would need to evaluate whether or not to to incorporate those changes um as recommended by csba I ask a followup trusty Pearson was your question on this on this item that trusty Rawlings asked no go ahead trusty Rawling thank you trusty Rollings thank you um so just to be clear um you will be so the ad hoc committee will you be identifying what is required and what is recommended in order to bring those items forward is that what you're proposing um to the extent possible
130yes but but you know to be clear this is a large volume of policies which haven't been reviewed we're trying to find a way to expedite the process and I think it would slow it down if staff needed to do a policy byol policy review of of you know changes in the law for example between 2006 and and 2021 in the case of that particular policy so um I think it'll be a work in progress we'll we'll establish the committee take a look at the information that csba has and um I I believe some of the policies will be very quick and easy to review oh there there's you know very few changes um but on some of the meteor ones uh I think yeah the the committee will need to sort of have a
131discussion and and make some recommendations back back to the full board thank you trusty Pearson so it's it's a two-parter uh I'm assuming but correct me if I'm wrong either Dr church or president Jones that this challenge of so many board policies is consistent with districts throughout California TK through2 districts they're having the same challenge yes sir yes indeed okay and so are some of these this new process um like best practices from those that have already gone and figured out a way to reduce the amount the backlog and being able to adjust or just just came out of our own creativity in terms of what we think yeah a little of both I mean I I know that there are districts that have standing board committees that review board policy um in some of
132those instances it feels like it's an additional board meeting that's scheduled once a month and and we thought um potentially by frontloading a lot of this work on a on an ad hoc committee we could um uh make better use of trustee and staff time at our regular monthly meetings so uh some of it is our own thinking about how best to move through the backlog um but certainly it was informed by by what other districts have done thank you trusty Williamson thank you um to miss Rollins point my I I I'm assuming that the board subcommittee if there were some questions about is this a mandate or is this a recommendation by csba then we would note that and and research would be done before it would then be presented to the board if
133there was um if there was an issue is that true Dr Churchill yes thank you that you you um you annunciated what I was unable to annunciate very clearly thank you that is correct okay and then to Mr Pearson's question um I know uh I have attended meetings with csba in the past where there are some boards who each board is assigned one has the 9,000 Series one has 18,000 series and so they any as as so they have they've done it that way depending kind of on their interest or whatever and so there I think there many different ways of breaking it up but but so it has been done in the past and just depending on on the interest in the suggestions of the of the board and the staff thank you trusty
134Williams okay I know you're gonna hate me about this um was there a thought about having like maybe two extra meetings and just getting these done done with and over with so so you know one of the discussions we had here was would that be a great use of time getting you know um all five trustees in the room to review 216 policies uh wouldn't be my recommendation I don't think that's a good use of time I think by having a smaller subcommittee that that can meet do some of the work individually outside of a meeting format come back in we're hopeful that that's the most streamlined process um if that makes sense yeah my only concern and and I would it would be helpful to get like footnotes is for each one what's why
135the change if there was like you're saying it's is it an ed code or is it just a modification because a lot of the times we're asking the same questions so if the ad hoc committee has those questions then we we're going to have the same questions in and board session and so that's I think that's why we need to make sure what are the changes and why yeah and and I'm sorry just to be clear yeah thank you yes I uh I hear the the concern and the question um but to be clear those 216 policies that have csba revisions which haven't been reflected here in our board policy manual um uh none of those are because there's been a change in the law and we haven't updated our policy right so of those
136216 zero should be oh because the law changed and we need to come into compliance with that new law um that's what we've been doing uh over the last couple of years and and you may have seen an uptick in the number of board policies that we've been bringing to you over the last couple of years to to stay on top of the legal compliance piece so so the you know though there will be other reasons that csba has recommended uh changes and updates to policies and yes to to the extent possible we we will share um what those reasons are and I would just add that I appreciated um the inclusion of csp's um rational or summary the high level summary this time that that helped because uh they weighed in on the you
137know change or recommendation and so I think that'll be helpful um for board members and then a followup to that is just uh this this is not that the ad hoc committee will be the only ones receiving these 216 policies all five board members will have transparency on all the 216 board policies so that there's no confusion in the public that only two people are deciding on these things this is everybody's going to have the same materials but the two ad hoc committee members will be the ones focused on sort of streamlining stream streamlining them into sort of buckets to to help sort of uh expedite the process for the board members anyone on this board can still ask questions is that correct about any of the policies that are being brought forward Dr Churchill
138yes ma'am absolutely you know in in one iteration of our thinking we thought that staff alone would do all this work and bring it back to the board but um you know Having learned over the years from many of you it's often more effective to have trustees in involved on the front end and to get some Buy in and and assistance and support so that then when we do bring it back to the full board your colleagues know that that uh at least two of you have been involved in the work so that that's that that's one of the reasons why we think having it be a board subcommittee is uh important thank you Dr Churchill truste Rawlings um will uh board policies that um address uh particular committees that we have and I'm thinking
139Wellness for instance will Wellness committee have the opportunity to review policies being updated around Wellness or will it just be straight the ad hoc committee yeah I I hadn't considered that I I think um that while anything is possible that certainly interjects you know another possible touch point that might be difficult to manage um so I I think you know my my my gut says my recommendation would be allow the ad hoc committee to do the work and then as those policies come forward to the full board um obviously those of you who are on the wellness committee for example have the opportunity to look at those with you know an extra set of eyes as a followup I mean I guess it wouldn't be a bad thing to maybe tag as we're going through
140the catch-up period say you know C compile a list like these you know 15 policies might impact or will impact the wellness committee may want to pay attention to these numbers and just draw their attention to it as opposed to having a secondary review with the committee to slow the process down as a suggestion yeah to to the extent possible certainly um uh I know the work is honorous already so I'm I'm not trying to make it harder on the subcommittee and less attractive to all of you who are just eager to jump into this work but just a suggestion any other discussion trustees seeing that there's no further discussion uh Dr Churchill uh if you could put the slide up with the three items for consensus again just so that we can oh actually
141I won't be able to get thumbs let me uh well I would say you need to ask first yes yeah I I I was under the impression we were in questions and then we're were going to do public comment and then have discussion before going into that is that accurate you are correct thank you trusty Rollings I apologize uh okay are we done with trusty questions great thank you uh if any member of the public wishes to provide public comment on the on this agenda item review and revision process for board policies and bylaws now is the time to do so if you are on the line press star n to indicate you wish to speak on this item no callers have indicated that they would like to speak on this item trustees now is
142the time for discussion okay as I see no no trustee hands up oh sorry trustee Rawlings thank you I was trying to figure out which button to push um uh I I'm going to go ahead and um uh volunteer since it was my agenda item so um uh to be on the subcommittee and um one of the things I do I would like to see as a and as a member of the ad hoc committee is is that we potentially form out some of these policies to the appropriate committees um to make and but that would be the responsibility of the the ad hoc Committee Member not the staff so would be one of my recommendations truste Williamson thank you um I think I look at this a little bit different than that I look
143at this as the so say trusty Rollins you are on the ad hoc committee one of the two board members your job is almost like a filter to that you're if anything needs to be flagged you would flag it so maybe you would be assigned to go would to go through 75 policies and you would on your own and you would go through those and you would anything that just for whatever reason didn't seem appropriate wasn't consistent with our with our practices as a district and then when you get together with the um entire subcommittee so with with the other board member as well as staff then you go over all the items that have been flagged and come to some type of a resolution or recommendation and then it goes to the full board
144and at the time that it goes to the full board uh my thought would be it it wouldn't be given to them on a Friday and have a board member on W a board meeting on the next Wednesday because there'll be 216 board policies there so it would maybe be given to the board on a Friday and say in two weeks you will we will be addressing this and so during that two weeks if you are on a committee that is specifically affected by some of the policies you have a respons ability to you know to meet with them so because I think that what why I like the concept of having this overall um initial screening is you get a Global Perspective as as you you'll start to see them you'll get the flavor
145for it you'll um and anyway and then it then it goes down to like the specific um committees if you see that that that that's needed so so anyway that that's I think that's my recommendation that's the way that I'm looking at it is there's the initial screening and then all the board members are given time and they would have the comments and they would be it would be transparent what the board subcommittee anything anything they had changed other than like grammatical issues but anything that was changed and a brief explanation so they would have all that my guess is 90% of the board policy would have would was they would just say fine you know there would be no issues any those are my thoughts thank you trusty Williamson trusty Pearson the only thing
146I would add to trusty Williamson's comments are that what I'd like to recommend is that we get updates from the subcommittee um as frequent as as realistically possible so we have some sense of how it's going because it's the first time we had this process and that we have some sense of when the first 2550 whatever the amount is it's going to come to us uh so we can prepare and if it's going to be a packet of board policies that we know that's coming to just so we can Clare our own personal agendas because there's going to be a lot of reading so and I would just recommend that thank you trusty Williams thank you um just in response to trusty Williamson the only issue would be that the ad hoc committee can't meet
147with the subcommittee of a certain like say Fran Wellness because they would have that discussion out of w me because they're brown act so thank you I thought the same thing because what if somebody outside of the two board members doing the ad hoc had a conflict so since we can't doe to brownc trusty Rawlings I guess that was one of the reasons why I was thinking that the ad hoc would kind of be the filter and say like okay here's 15 policies that apply to Wellness and so it wouldn't fall on that the the burden of the work would not fall solely on two board members and that it wouldn't be a discussion it would just be that becomes their responsibility as part of their committee work um but again that I mean I'm
148open to whatever process works but that was my thought process since the whatever committee it is and again I'm using Wellness as a um as a uh you know as an example but there's other committees that would have policies that um specifically are part of their work anyway and that that may take some of the burden at least to do the initial filtering and the take a look at what the recommendations are and how it impacts their work so that was the reason I was bringing it up but I'm flexible I'm not you know uh wetted to any particular uh process thank you and I have a followup to trustee Pearson's comment as a suggestion is that uh maybe the packet that is provided to the um ad hoc committee members that the entire packet
149is provided at the same time to the rest of the board uh and then that way starting at the same time if we wanted to start leafing through them and there were immediate things that were flagged then that board member could communicate with Dr Churchill and say you know I have concerns about this or you know these 50 there were only grammar changes from May to Shell or whatever you know that I suspect that there will be a number that won't need heavy review because they're just grammatical changes but um if if that's agreeable then I would make that as a s suggestion for the team because that way for those of us who are interested we can get a jump start on kind of combing through some of the policy updates uh yeah I
150guess my only question would be just one of clarification then are all five trustees reviewing all board policies individually well we will at some point or the other and and as Ray as trustey PE indicated it will be a lot of reading and so for some of us with time constraints it'll help you know doing a little bit when we can get time we be helpful yeah no that that absolutely I understand I guess I maybe I'm a little bit more worried about process if and let's say we've got a established ad hoc board subcommittee that I'm going to be working with and then if I've got two or three other trustees also sending me information relative to the policies that we're reviewing as a committee it it just might be challenging to manage thank
151you I appreciate that feedback trusty Pearson off KCK that off to your comments Dr Churchill and president Jones um I think there's a qualitative quantitative analysis of the process so and I appreciate Dr Churchill and and the team your team putting this together because I think that you're taking into consideration both of those because it's a masses a massive amount of policy to review so I'm I am going to be supportive of the two board members and thank you trusty Rawlings for jumping in there because that is going to be a massive challenge but I'm going to trust whoever the other trustee is that they will vet uh knowing kind of um knowing our practices knowing our current policies we'll be working with Dr Churchill also knowing kind of our sentiments you know because we've
152worked together for a while as well uh you always need to get those three votes so I think that figures into the process so I'm more inclined to have the two trustees really kind of work through and then bring their recommendations to the full board thank you trusty Parson trusty Williamson um I will volunteer to be the second board member sub committee person unless someone else really wants to do it and um and I I I think that I to to make everyone feel more comfortable it's important that the other three board members have PL have enough time to go through them once once the subcommittee has has done its work so it it may end up being a matter of we send a package of 216 to everyone at once once the board board
153board subcommittee has done its work but then say okay at the February meeting we're going to address the first hundred and at the March meeting we'll we'll do this you know so to but but as long as we give enough notice and then board members can can can let us know hey there's just not enough time and then we would have to address it but I think if we have the expectation that it will be sent out to EV to all the board members in sufficient time that they will be able to review them before being asked to vote on it I I think that's an important part of the process thank you trusty Williamson trusty Pearson so I I agree with trusty Williamson on uh process um I just think her numbers are really
154um for me pretty aggressive um so which which I and I think Dr church will probably has some historical um historical data about how well we as a board have been able to uh take certain amount of numbers of of of board policies and be able to make decisions on those first second or even third readings so Dr Churchill I I think you probably have a number that it's probably what's practical uh for US based on our history yeah thank you I you know I I guess you know part part of me is um looking forward to getting into the work and we'll assess as we go um historically you know this board you know hasn't really ever reviewed more than 10 or 12 policies in in one sitting at one meeting but historically this
155board hasn't had a subcommittee made up of Trustees who are doing the vetting in advance so I I think we can absolutely increase the number of policies we bring back to you um uh you know more than 10 in a meeting I think we can bring a much larger slate especially if um after the analysis you know half of them require no update um just you know we're going to Mark we reviewed it no update move on uh I think the the number I think we'll be able to move pretty quickly through it but I appreciate the the comment about the sort of historical nature of how many we've done I mean as I noted we've done about 50 a year um we're talking about doing you know 50 to 100 in a month um
156it'll it'll an interesting process I look forward to seeing how it works thank you trusty Rawlings thank you and thank you trusty Williamson for uh joining me I was hoping you would volunteer uh with your with your amazing skills when it comes to uh uh grammar and sentence structure and those types of things um one of the things I was thinking is um what if we were to bring them forward in um sections so like all the 5,000 uh would be come in one section would come in one and then all the 9000s would come in another um that would be helpful for me just to stay within the same topic area or general topic area um and that may be a way to streamline the process a little bit yeah thanks I'll definitely take
157a look at that as we start to think about how to um divide them up we'll have to see what number of policies is in within within each of the thousands um so there's more is to do on our end but we'll take that in consideration thank you trusty Pearson I just like to uh thank both trusty wison and trusty Rollings for volunteering and um you know just support them in that and be glad when you guys when both of you both start immediately thank you any other discussion okay so Dr Church chill has asked us for consensus to form an ad hoc board subcommittee to work with staff actually Dr Churchill can you read the three so I can see everybody on the screen oh yeah sure thing thank you okay so on the
158first one uh I need consensus to form a board ad hoc sub uh committee for review that's right and on top of that I think it sounded like trusty Williamson and trusty William trusty rings as the members so it's two things on this one thank you a thumbs up thank you that's uh five including and six with our student board representative thank you and then the second item Dr churo um is H just to um is there consensus around the general process we described for catching up on the 216 policies all thumbs up thank you than you and then the last one um is there consensus around our recommended process for managing ongoing updates as we receive them from cspa yep uh trusty Williams I didn't see you okay all thums wonderful thank you I
159uh I appreciate it thank you thank you trustees uh it is 8:19 and I'd like to recommend a a 10-minute bio break this would bring us back at 8:29 thank you okay welcome back everyone um we are we are at item 7.6 resolution number 18- 2122 supporting School solar and net energy meter metering 3.0 uh if any member of the public wishes to provide public comment on this agenda item the time to do so will be following staff's presentation and before board deliberation if you are online please press star9 to indicate you wish to speak on this item I'll call for speakers again following the staff's presentation and we'll let you know when it's your time to speak trustees this is a discussion action item and for this I'll turn it over to Dr Churchill
160thank you very much um oops so this item uh is on the agenda this evening uh because during the governance requests portion of the October 13th meeting trusty Rawlings requested that staff place a resolution on the November meeting to to oppose a proposal put I'm sorry requested that staff place a resolution on the November meeting to oppose a proposal put forward to the cpuc that would disincentivize solar energy and reduce Savings in our Solar investment uh so you see on your bardock's agenda the resolution that was requested for your consideration um I'm happy to answer any questions any truste questions okay seeing that there are no trustee questions if any member of the public wishes to provide public comment on this agenda item now is the time to do so if you are on the
161line please press star n it looks like there are two callers or that have indicated they'd like to speak to this item as noted uh in in our agenda no individual presentation shall be for more than 3 minutes and the total time for this purpose shall not exceed 20 minutes ordinarily uh board members will not respond to presentations and no action may be taken however the board may give direction to staff following a presentation speakers are asked to State their name and please indicate whether or not you live within the boundaries of the school district when we call the last four digits of your phone number press star six to unmute you will have 3 minutes uh we will have we'll place a timer on the screen and we we we will mute your mic
162when your time has expired actually trustees there was a third color that uh uh indicated they would like to speak to the item our first color that uh indicated they'd like to speak is uh last four digits is and star six to unmute hello my name is David steel and I do live here in the Carlsbad Unified School District um I work as a solar consultant for power public benefit corporation which is also headquartered here in carlbad and I strongly encourage the board to approve the rooftop solar resolution today I'd like I would like to see carlbad Unified School District take a stand for the continued growth of rooftop solar uh because we really need to make it easier for schools and citizens to get solar not harder rooftop solar gives schools and homeowners the
163power to control their energy costs this is truly an effort by the utilities to grab more profits at the expense of all California school districts and the public uh metering version 3.0 which is heavily supported by the big energy lobbies will result in calls that citizens losing as much as 75% of the value of the energy credits they create during the day many solar um making solar power um less economically viable than ever utility companies also proposed to make schools and home owners pay a much higher monthly charge for the benefit of going solar and in addition the utilities are wanting to change the energy true up from an annual program to a monthly program um any of these things would be really just slows the adoption of solar in a huge way um in
164the last decade California has paved the way for domestic solar with almost half of the solar systems installed in the US installed here California solar future belongs to everyone and every home should be able to harness the power for long-term Energy savings and Independence again please approve rooftop solar the rooftop solar resolution today thank you so much thank you our next caller is 1436 and star six to unmute good evening board president Jones and trustees my name is Tara Hammond I'm the founder of Hammond climate Solutions serving all of San Diego County and I live in San Diego thank you for bringing forward this net metering resolution I am deeply worried about the future that the kids today will inherit we are in a climate emergency and cannot afford to take away a viable solution
165that helps reduce impacts of the climate crisis while many school districts across the state have weighed in on this important topic I'm excited to see Carl's fad to be the first school district in the county to agendize this net metering resolution many of the solar benefits um in there are many rooftop solar benefits including helping schools save money that can be reinvested back into the students rooftop solar has also provided Local Schools a great educational tool to teach students about clean energy and green jobs we should be talking about how to get every local school to have solar and storage turning schools into resilience hubs but instead we're discussing the investor and utilities metering proposal that will increase fossil fuel consumption increase sg's profits while raising rates for families schools cities businesses and other organizations
166I urge you to please adopt the resolution tonight sending a strong message that Carl's B School District wants to keep rooftop solar as a viable solution to stop climate injustices and the climate crisis I think you for your time and consideration and I hope you adopt the resolution helping create a more just and livable future for all thank you thank you our final caller is 0396 good evening president Joan and and trustees my name is Karina Gonzalez and I am the climate Justice policy adviser with Hammond climate Solutions I do not live within the boundaries of the district however this is an issue that goes across cities counties and schools board lines I strongly encourage the board to adopt the resolution standing up for a strong net energy metering which will send a strong message
167to the California Public Utilities Commission that the carad school district wants to see solar continue to grow we should be investing in our schools turning schools into resilience hubs and a safe space for students and the community not to disincentivize Rooftop solar for Monopoly utility benefits the cities of salana Beach San Diego and Chul Vista recently adopted resolutions advocating for a strong net energy metering 3.0 along with over 40 local organizations who have signed on to a letter because they understand the impact that a bad decision will have on San Diego residents businesses nonprofits and schools the city of carlbad climate action plan includes rooftop solar on residential and commercial buildings as a key ghg reduction measure and if the net energy metering proposal that the utilities are proposing is adopted it will make it
168nearly impossible for the city to reach those goals solar can not only provide savings to schools but also provides an educational opportunity and teaches students about environmental stewardship thank you so much for your time and I hope you adopt this resolution to support solar which is a key solution in fighting the climate crisis thank you that was our final caller on this item uh trustees may I have a motion to approve resolution number 18- 2122 supporting School solar and NM 3.0 exhibit as as um displayed in exhibit a so moved drawlings second Williams thank you uh that was a motion by truste Rawlings and seconded by truste Williams and now board discussion truste Pearson um I'll be supporting this resolution but I was disappointed not to have any students or not have uh no other
169than Mina here but other students uh come forward and talk and at least call us or let us know their support the resolution as well as parents from Carl's B the three callers were outside of Carl's B actually um that's what they said so so they outside of Carl's bed um but I'll primarily be supporting because uh I think the point was brought up about the importance of having rates for us for schools that are not ridiculous and no rationale no no business rationale for net metering from utilities and as a business person that's what I was looking at and that our second highest uh expense in our district is utilities and the second is that it does have an impact and solar's been around for a while now and has had a positive impact
170especially to our Coastal communities and and and just our Co communities in large in California has been a Trailblazer in this area so those are the reasons I'll be uh supporting it thank you trusty rowlings uh can we have our student representative go go ahead she's had her hand up thank you uh Mina please go ahead I can figure out how to raise my hand on Zoom I don't think I have the option but I was really hoping to talk about this I took some notes about it while I heard the discussions um I actually sit on the board of crb high schools green Club so this is something that we've discussed in a lot of our meetings and hope to bring to the board at some point after talking to Dr Brockett so I'm
171glad that it's being discuss now and I just wanted to say that right now we do have the solar panels um in the parking lot and that's something that we're all really enthusiastic about not just because it provides a ton of shade on hot days but also because it shows us that there is a viable solution towards solving the problem of climate change because I feel like a lot of the problem is that we feel like there's nothing that we can do at like a school level it's all like everybody says it's big corporations and that sort of problem so I think just even something as small as having more solar around campus it's something that we see on a daily basis and brings more attention to the bigger problem of climate change and shows
172us that there's something that we can do on a more local level so I definitely think expanding it is a really good thing that the students will support thank you Mina we appreciate your comments truste Rawlings thank you and thank you for uh those comments Mina um uh and uh trusty Pearson I just want to say the first caller was a business owner in Carl's dad he did say he was a he owned a Solar Company I believe in Carl's dad so I just wanted to say that that we did have one caller and um but I do agree that um uh that uh for the Earth it's very important uh you know we are in a climate crisis and um every little bit helps um but also too I mean we have almost a
173S7 million dollar investment in the in the solar panels and I do believe that we made a commitment to the taxpayers of Carl's bad that we would at least stand up for that investment and uh Our Hope was is to have a onetime spend on the solar panels and to be able to have ongoing savings that would go back into our classrooms and so um so that's why you know I wanted to bring this forward because what seems to be missing in the conversation you have a lot of environmentalists coming forward to the CPU you have a lot of cities coming forward but it seems like uh the schools get left behind and uh we have huge Investments uh in the Solar space and I just believe we have an obligation to protect those Investments
174so I will be voting in favor thank you trusty Rollings trusty Williamson thank you and I appreciate the comments that have been made so far I will be voting no on this resolution as as our practice I will explain my vote my first concern is related to staff time I had several questions for staff related to this resolution including is there a nonpartisan analysis of the proposed update I want to make sure that we're voting on balanced information before making a decision I believe that we have the obligation to do so in particular if what is the statement quote changes to net metering that would have the potential to deter student school districts from investing in solar close quote what are they based on I would also want to see the potential impact to other
175rate payers shareholders Etc if the proposed change is made and if it isn't made I shared my questions with staff after doing so however I let them know that I really didn't want them to take the time to find the answers my focus as a board member is student learning and I closely scrutinize anything that diverts staff's attention away from student learning including staff in including instructing staff to spend time on resolutions that are not part of our regular agenda I spoke with Dr Churchill and he um acknowledged that it would have taken many hours to answer my questions my second concern is the impact on the effectiveness of our governance team I believe one of the reasons for our strong governance team is is that we don't typically that we don't have a partisan
176voting block unlike many other school boards that have I believe that one of the main reasons for this is that we have a stud taking up elective I'll call them political social environmental or environmental issues including resolutions I I totally support individual board members in their work on issues that are important to them as well as encouraging students to to join our efforts and I have I also have some strong issues that I some issues that I feel very strongly about that I that I focus a lot of my time on however as a board I encourage us to focus on matters directly related to our goals and success indicators I wish to note that my no vote in no way reflects my personal feelings about solar panels as evidenced by the fact that my
177family spent thousands of dollars to install solar panels on our own roof and I am a strong supporter of of solar panels If This Were an issue that um I have spent a lot of time on I would also be voting no on for the same reasons that I am going to be voting on this thank you thank you any other comments trustees uh truste Williams thank you um trusty Williamson well I appreciate your uh feedback and your information I will be supporting this and it's because we supported in our prop um sorry measure HH we in invested in solar panels I just want to make sure we're we're um we're advocating and supporting our our investments that we made in measure H thank you thank you any other discussion seeing that there's no further
178discussion Miss Garcia will you please call for a vote student representative bakovic yes trustee Williams yes truste Rawlings yes truste Pearson yes trusty Williamson no trusty Jones yes thank you trustees this brings us to item 7.7 resolution uh and I apologize thank you Dr Churchill for the last item get my manners there uh item 7.7 resolution number 19- 2122 continuing Board of Trustees authority to hold virtual meetings pursuant to AB 361 if any member of the public wishes to provide public comment on this agenda item uh the time to do so will be following staff's presentation and before the board's deliberation if you are on the line press star N9 now to indicate you wish to speak on this item I'll call for speakers again following um the board's or sorry I'll call for speakers
179again following the staff's presentation and we'll then let you know when it is your time to speak trustees this item is a discussion action item and for this I'll turn it over to Dr Churchill thank you trusty [Music] Jones uh one moment there we go so uh this item is uh one that we've seen in the past as as you're aware uh we are required every 30 days to um have the board deliberate and make a determination about meetings remaining virtual uh that's related to the enactment of assembly Bill 361 which was uh put in place in uh September 2021 so that's what we're doing this evening um we're first going to look at a little bit of data uh before we get into the discussion uh We've we've shared um information from the county
180as San Diego uh at various points over the last 18 months um this is a slide from last week's update um where it shows CDC levels of community transmission uh across the county and you can see uh on this chart and it is from last Wednesday's um uh update I was unable to pull the update that came out this evening uh while we're in this meeting uh but you can see that over the last um period of time here September October beginning of November we've been in either substantial or high transmission in terms of weekly case rate in San Diego County according to CDC levels of community transmission um here's another slide from last week's update uh from the county just showing uh covid-19 case rate by vaccination status and um what what I think
181is most important to note here is when when you look uh you know in June even into early July where the case rates were pretty low uh they spiked they've come down um certainly uh and and in late October into early November um they've come down but they're certainly not where they were uh in uh late June early July uh when we look at city data this came from the presentation given last night at the or yesterday afternoon at the city of Carl bads city council meeting uh you can see that here in um the city of Carl's Bad Active cases um are are very similar in the late June early July time frame uh case counts were low here in the city of carlbad they spiked they've come back down but they're certainly not
182um back to where they were uh when uh when both school district and the city council went back to inperson meetings briefly uh in July so that's the data um city council did vote um last night or yesterday afternoon I'm sorry to um uh extend their meetings virtually for the next 30 days um it's our recommendation uh that the board uh here for the school district do the same um I'll uh ask for board questions uh again move to public comment and then we come back and ask for uh discussion and a vote on the resolution thank you Dr Churchill uh board questions for staff same there are no questions for staff if any member of the public wishes to um provide public comment on this agenda item now is the time to do so
183if you are on the line please press star 9 to indicate you wish to speak to this item uh I see that we have one caller who has indicated they'd like to speak to this item as noted in our agenda no individual presentation shall be for more than 3 minutes and the total time for this purpose shall not exceed 20 minutes ordinarily board members will not respond to presentations and no action may be taken however the board may give direction to staff following a presentation speakers are asked to State their name and indicate whether or not they live within the boundaries of the school district when we call the last four digits of your phone number please press star six to unmute you will have 3 minutes and there will be a timer uh that
184we'll put up on the screen and we'll mute your mic uh when that time has expired our first and only caller is 181 good evening trustees and superintendent Churchill my name is Scott Davidson I'm a resident of carlbad and the parent of a high school student in the carlbad Unified School District I am speaking this evening to oppose the recommendation that this board approved the resolution to continue holding virtual meetings under AB 361 to continue to hold virtual meetings this legislative body must first first determine whether or not an active state of emergency exists that makes meeting in person unsafe if a state of emergency of this nature exists then the legislative body May hold a remote meeting essentially if it believes a meeting in person would present quote imminent risks to the health or
185safety of attendees unquote as I hope our board is aware students meet daily on campus in the thousands in classrooms with over 30 students for hours at a time as mentioned by fire student representative this evening the carlbad volleyball team just celebrated a great win where hundreds of fans gathered indoors mostly mless and excitedly rushed the court to celebrate the win last weekend hundreds of fans packed the stands of Carl's bed High all massless to yell scream and cheer the CHS playoff win tonight's public comments further evidenced the countless meetings Spirit events dances games and other activities where our students gather almost nightly without any thought of an emergency finally as of two weeks ago all children and adults on campus are eligible to be vaccinated effectively reducing the statistical zero risk for all students
186to well statistically zero furthering a message that we are in still in a state of emergency simply further undermines vaccine messaging and furthers an irrational fear of a virus so while this board and superintendent appear to still live in a state of emergency it appears you are alone the the rest of the district that you serve including students parents and staff clearly does not believe that there is anything close to a state of emergency going on or that meeting in person is at all dangerous before you vote on this resolution tonight I would hope that you would ask what kind of message it sends to our students to the parents to your own staff that you personally do not believe it is safe to hold a public meeting with a few dozen people when thousands
187do so every day at school and thousands do so every afternoon every evening and every weekend at Carl head unified events I would of course expect that if you do ratify the decision to continue meeting virtually that you exemplify your decision by refusing to attend any of these events and convey to the community that you do not believe these events are safe thank you thank you uh may I have a motion to approve resolution number 19- 2122 continuing Board of Trustees authority to hold virtual meetings pursuant to uh AB 361 as provided in exhibit a so move drawlings second Williamson thank you that's a motion by truste ring Rawlings seconded by truste Williamson board discussion uh truste Pearson as it is our practice for a no vote I will not be supporting this resolution because
188there are proven Health precautions we can put in place to hold in-person and stream meetings the same as in our classrooms we ask students teachers administrators support staff for in-person instruction the County Supervisors meeting are held in person Carl's Bad has Active cases much lower than the summer surge among the lowest rates of hospitalization ICU Admissions and deaths in North County much lower on all metrics than the county average is time for inperson board meetings thank you trusty Williamson thank you I support staff's recommendation regarding holding the December 15th meeting virtually but in hopes of meeting in person beginning in January I would like to support of my fellow board members to instruct staff to add a section to our posted agendas relative to public participation similar to what the San Diego County Board of
189Supervisors has created in addition I recommend that we direct staff to be more explicit in the language regarding the fact that comment times may be shortened depending on the number of speakers perhaps stating that each speaker may be limited to two minutes if there are eight to 10 speakers or and one minute if there 11 or more speakers additionally if there are more than 20 speakers speakers number 21 and on and above would be moved to the end of the meeting in order for the board to conduct the board's business during the meeting staff would then bring back the proposed language at the December meeting so we could then make the change at the January meeting thank you trusty Williams thank you I just have a question over trusty Williamson which um what language are
190you referring to with the board of Supervisors uh the staff provided some information to us in response to a question and if you go onto the board of County Board of Supervisors um website and their policies it that that language is included there thank you thank you trusty Rings sorry um I would be um glad to support the um uh your proposal trusty Williamson um my only hesitation would be that um we need to ensure that there's enforcement of the any rules that we set forth um uh I believe that that's um part of the um uh and actually have consequences for a violation of the rules um that if there are disruptions at our meetings if there are you know if you go beyond the time limit those types of things we need to
191have a mechanism in order to do that and so I'd be happy to meet in person um but um I do believe that that um that we need to um uh enforce the rules as they stand and um it's just like in a classroom uh you have to have classroom management and uh if um if if you're not enforcing the rules um as my mom would say uh you would uh um you give them an inch they'll take a mile so I do believe I would be happy to meet in person so long as there's enforcement of of whatever rules we decide on thank you trusty Pearson um I appreciate uh trusty Rawlings comments but uh anything I'm going to support is uncoupled between protocols and health I see them as two different issues and
192that's why I if we if we're having a open board meetings it has nothing to do with health um on those comments so we should be having those protocols in place no matter if there was a covid or notco going on so I I I think those connecting those two I I couldn't agree with those thank you any further discussion trustees seeing that there's no further discussion Miss Garcia will you please call for a vote I'm sorry trusty Jones yes uh I apologize I do believe trusty Williamson was asking for uh perhaps consensus via thumbs on on I apologize okay uh truste Williamson is asking for consensus would you please read back uh what you're asking for consensus on yes I would like support of my fellow board members to instruct staff to add a
193section to our to our posted agendas relative to public participation similar to what the San Diego County Board of Supervisors has created in addition I recommend that we direct staff to be more explicit in the language regarding the fact that comment times may be shortened depending on the number of speakers perhaps stating that each speaker may be limited to two minutes if there are eight to 10 speakers and to one minute if there are 11 or more or more speakers additionally if there are more than 20 speakers speakers numbers 21 and Beyond would be moved to the end of the meeting in order for the board to conduct the board's business during the meeting staff would bring back the proposed language at the December meeting and so I guess I have a question and since
194we're in board discussion I'm going to ask the question in the protocols um in terms of uh as trustee Pearson mentioned uh the health aspect of it um we've got broad feedback on the health and safety of convening in public because there are members of our community who are concerned in both directions some that aren't concerned at all and others who are very concerned um did were there uh I guess without having them the protocols of the County Board of Supervisors to display currently are there measures that would protect both um both um constituencies on the side of that issue trusty Williamson well I believe the current um regulation is that if you are in that you can be indoors unmasked if you're vaccinated I believe and and if you are unvaccinated obviously you need
195to be masked and so that that would I mean obviously that would be part of it as well as the the policies the procedure is um that that is very clear about carrying signs or um being restricted or you know limiting yourself to the the uh time limits and things like that so is there to the question is there a direct statement about maintaining three feet that that's that's not included in what I saw from the County Board of Supervisors at least okay and then I guess jump in I'm sorry no just to to your question you know we we don't have that information up available in front of us right now but that would be part of a presentation in December is to you know to let you know how the County Board of
196Supervisors is handling um the orderly running of their meetings and and then staff would be prepared at that time to make some recommendations about um uh you know how orderly running of our meetings so okay I see so the item will come back to the December meeting okay thank you further clarification truste Rawlings um without specifics on again enforcement and not necessarily just the procedural aspect but also um uh you know to are we going to ask for proof of vaccination are we going to do on the honor System I mean we the last meeting we had in person and we had people specifically saying that they were not vaccinated and they were unasked and so um I just want to know what those or folks that weren't eligible to receive vaccinations and they were
197unmasks so I'm trying to figure out how we would enforce those health and safety aspects in order to protect other members of the public that um are concerned about that because I do think we have the um obligation to provide a safe um and effective meeting for all of our constituents not just um uh one section of them yeah and and if I may you know all excellent questions I think that would be part of what we would bring back to the board uh for review discussion and and an ultimate decision so um I don't think it'd be appropriate to make any of those decisions here tonight we we uh staff would respectfully ask for some time to pull all this information together and and bring it back to you in December so is that
198part a request then that that was part of trusty Williamson's request yes okay I didn't hear that part so I just want to verify with trusty Williamson that that's part of their request as well yes okay then then I could support it so long as that's part of it as well okay so we're calling for consensus to have a um item brought back to the December meeting um I guess prior to this passing of this resolution or as part of this resolution because it feels bifurcated yeah why don't when we get to an agenda planning um session we can talk about how best to agendize this whether or not it's part of a similar resolution or a standalone I haven't haven't thought that through yet my guess is your uh president Jones you're going to
