004a clothing designer with a limited education he planned to be a lawyer and serve in Congress he was rejected from multiple Labs after Medical School the March of Dimes Foundation funded his research he tested the polio vaccine on his own family and I like to just a few quotes from him relevant to education that I I pulled from uh Jonas sulk he said as a child I was not interested in science I was merely interested in things human The Human Side of nature if you like and I continue to be interested in that that's what motivates me another couple quotes there's Hope and Dreams imagination and in the courage of those who wish to make those dreams a reality the reward for work well done is the opportunity to do more and the last one

007not successful just yet oh I see someone joining I think yes Miss Humphrey has joined us just in time it is uh we're at it just to catch you up first welcome Miss Humphrey thank you for joining us at the board meeting this um tonight um it is your item report by the student representative to the board so not to throw you in but here you go okay awesome I'm so sorry there was some technical difficulties on my end but okay so starting with Sage Creek the Athletics is in full swing for The Fall season where girls golf volleyball cross country field hockey and Tennis are all competing and doing very well there's a surf team kickoff meeting this Thursday which I personally am very excited about ASB has started the Buddy program where each

008staff member and each ASB student are buddied up to establish community and build relationships link crew continues to work on building relationships for our students by providing orientation for our freshmen and linking up with students during the advisory period by visiting classrooms which I'm also a part of and I enjoy and then the pals the pure assistant listeners program which I'm also a part of is um it's going very well and it's a new program on campus it's also at CHS and it's all about supporting mental health and the well-being of students it's students assisting students and it has been very positive as for carlbad high school there was a new student lunch last Tuesday a club Fair Friday at lunch this Friday um there was a home football game last Friday they beat El

009Camino 28 to4 and their team is undef defeated 40 there was an away away football game this Friday or there is a away football game this Friday at Mission Hills there was the first speech and debate tournament last Saturday and the Freshman C Class Council election and results were announced last week and they are prepping for homecoming which is planned to be on October 1st moving on to carlbad Seaside Academy they're starting up the year with 234 students in in grades K through 12 and the staff is working on bringing students on campus to meet one-on-one with teachers and to start working more in small groups the elementary school program will start to also have these small groups but at buen ofice to campus later in the school year and then Carl's Bad Village Academy

010has brought an art program to campus and has converted the kitchen in room 813 into an art room and the goal is for students to learn about and create art in different ways and then over the summer the summer the school hired Miss Whitney Weaver and that's all great job thank you so much for jumping right in there next we have item 5.2 superintendence report Dr Churchill thank you and of course it's a tough act to follow our student board reps uh so while I'm here uh uh sweating and stressing trying to figure out what the tech problems are in the background um just look at how awesome our our young people are she jumped right in there calm cool and collected uh we are very fortunate to have Miss Humphrey on uh on our

011board as a student board rep I look forward to introducing the other two students in our coming months uh dalan Rose chunko from csac CBA and Mina pasca witch I just murdered the name there but um uh pacov darn it Mina will be here uh from carlb high school I'm going to share my screen I have two items to present as part of the superintendent report uh the first is our annual uh opening of schools report uh here's an infographic that we put together as we do at the start of each year typically uh we provide this report to you at the first meeting following at the start of the school year uh our our last meeting was just before the beginning of the school year so we're a little later here we're in the

012fourth week but it has been a great four weeks of of school um there's four areas I want to touch on here in terms of our students you'll see we open the year with just over 11,300 students our enrollment is slightly higher this year than it was at the same point last year which is very positive um it's still a little bit lower than it was overall pre pandemic uh but we have not suffered the significant decline in student enrollment that many school districts have and so we're we're fortunate there uh we also highlight our staff we have over 1100 uh regular staff that includes certificated classified and other regular staff uh and we we have so many amazing people here uh the carlb Chamber of Commerce came out yesterday with their sead Awards and

013the lists of finalists uh they recognize an admin istrator of the year and several teachers of the year and I was very proud to see a number of our leaders and teachers uh listed as finalists for the carlbad chambers seabat Awards uh next week we're also going to be recognizing Dr NY our assistant superintendent for instructional Services uh he is the 21 um 2021 Award winner from classroom of the future foundations's Innovative educator of the Year award uh and and you know we're very very fortunate to have Dr n his leadership here uh we've had some challenges in the staff area certainly um nationally and locally we've seen shortage of subs and a challenge in hiring nutrition services workers special education AIDS um but but that said we're still uh we're doing well this school

014year uh Dr NY will be talking about our student performance data shortly this evening uh you know there's a couple of data points here um that despite the pandemic we're we're at an all-time high 98% of the the class of 2020 graduated on time um and and if you think about it those seniors last year uh they ended their junior year with school closures and they went through big chunk of their senior year with school closures and yet we still had um the highest graduation rate that we've had in some time uh and our a through G rate is as high as it has been uh ever with 83% of our our students graduating last year eligible for acceptance into the University of California and the Cal State systems uh that's that's what the ather

015G rate is uh finally we shared some information about um the state and federal covid funds that we have uh been allocated and and and spent or in the process of spending uh in addition to virus transmission mitigation efforts we have increased staff in a number of key areas we've hired Elementary counselors for the first time in our district and that's a real positive as we think about um mental and emotional health for all students uh We've increased our psyches health tax uh teachers Etc um while we're on the topic of covid I just want to know uh there's been questions about um vaccination status of staff and the rates in our district uh we're we're pleased to be able to report that our staff vaccination rate is over 87% um and and uh that's

016all employees together when you look just at our teachers it's even higher um the student vaccination rate I was hopeful that before this meeting started I could get uh this week's numbers the the county updates them on Wednesdays um I wasn't able to pull them but at this time last week uh in North Coastal San Diego County uh 12 to 17 year olds had a vaccination rate of 58% uh so countywide about 68% of 12 12 to 17 year olds are currently vaccinated here in the north Coastal re region it's about 10 points lower than that at 58% but we are hoping to see an increase in those numbers over time we had a successful vaccination event at carlb high school on September 7th and we'll have another one on September 28th that's the first

017half of the superintendent report uh second half I want to make mention of uh the California reading report card uh so there's a group called The California reading Coalition uh they just released uh the California reading report card uh and they named carlb unified as one of the top school districts in the state for reading instruction the California reading Coalition looks at a specific group of students as a proxy for all students in the district and then Compares similar students in districts across the state their focus is on uh lowincome Hispanic students uh and and and so that Hispanic Latino uh socioeconomically disadvantaged or low-income group is the largest student group in the state so so 43% of all students in California fall into this category of lowincome Hispanic students uh the California reading report

018card measures that group of students reading proficiency at the third grade which is a pivotal year when it comes to the acquisition of reading skills so in their most recent study carlb unified was ranked in the top 30 of all school districts in California when it comes to the reading proficiency of this particular group of students lowincome Hispanic third graders and again that's used as a proxy to show the effectiveness of the reading program across all grades and all students the rankings this year include districts with 100 or more low-income Hispanic third graders these districts make up 287 of California's over 1,000 school districts enrolling 72% of all students in California uh so the fact that we are in the top 30 of all school districts in the state on this metric I think is

019something we should be proud of today as you may know is the first day of Hispanic Heritage Month which is recognized from September 15th to October 15 and I thought that this particular data point was worthy of sharing tonight and that concludes my report thank you Dr Churchill this brings us to item 5.3 oral Communications oral Communications is for non-agenda items as noted in our agenda no individual presentation shall be for more than 3 minutes and the total time for this purpose shall not exceed 20 minutes ordinarily board members will not respond to presentations and no action may be taken however the board may give direction to staff following a presentation trustees tonight we have eight registered speakers um and that will bring us to a total of 24 minutes may I have consensus to

020extend the time to hear every speaker for three minutes so an additional four minutes thank you all that's five thumbs speakers are asked to State their name and indicate whether or not they live within the boundaries of the school district uh our first speaker is monacy Watts please press star 6 to unmute and you will have three minutes uh Dr Churchill you'll put the timer up thank you and the last four numbers are 3255 good evening can you hear me yes go ahead good evening my name is Mony watts and as president of the carlbad unified Council of ptas it's my pleasure to update you tonight on the activities and plans of the Carl's dad ptas exactly what does PTA do on our school campuses and why should you you become a member today PTA

023share that influential programs are back on campus in person I have several special programs to provide specific highlights for first Lego week teams are meeting weekly we are fortunate to have a new program coordinator this year Linda D who is managing both our first Lego League robotics program which serves students in elementary and middle school as well as our first Tech Challenge High School progam robotics program this is a change from previous years and will allow for greater collaboration between these two related programs as a more experienced FTC robotics participants Mentor younger L students secondly student leadership Council will kick off their first meeting next Wednesday at Sage Creek High School we are pleased to welcome 48 students to this year's program most students involved will participate for two to three years this allows seniors

024to take an active role in mentoring younger students in leadership last year's program was run entirely virtually and we can't wait to meet with students again in person Science Olympiad will kick off in October huge thanks to Valley Middle School who has offered to host practices kids pair has welcomed 750 students this year offering Afterschool Care at each of our nine Elementary Schools Enrollment continues to be open for new families with each of our programs we have taken extra precautions to minimize potential covid-19 exposure when possible programs take place outdoors and socially distance we're thankful to be able to provide the Hands-On enriching activities our students love thank you and have a great evening thank you next caller is Mike Bell 5 452 and Then star six to unmute Mike Burell hello can you hear

025me yes go ahead yeah my name is Mike bll uh I am a resident here in carlbad uh my daughter attended uh carlb High School the past but that's been like years back but I'm calling today because I'm very concerned about uh the welfare of the children uh in the schools uh if you look at today's closed meeting at board agenda you'll see items involving uh both pending and anticipated lawsuits so I believe your board believes hiding you know behind their computer screens and citing uh illegitimate emergency order is a reason to to the public I think it's cowardly that they do that uh I just wanted to get that out of the way but uh I'm a scientist engineer actually i' I've given science shows uh to Carl's Bad over the last decade uh

026the science teachers know me at aiera and Valley and there is no science being used to make your decisions uh the Lynch pin in in this what laughable if not sad charade of of masking uh is is the gaps in The Mask you got to look at the science uh that is e exposed by environmental hygienist and toxic toxicologists the the face seal is the weak point however minute it permits the virus that's Laden with aerosols under 10 microns to enter and exit the mask so masks are only effective in stopping droplet sized particles and these droplets are ballistic in nature uh if you cough or sneeze they're large enough that gravity pulls them to the ground within a few seconds and it's really the aerosols uh if you have Virus Infection uh they're going

027to remain in the room uh for up to hours and these masks just don't work if you do your research if you do your due diligence you'll come to the same conclusion that Ramona did don't don't let the kids suffer any longer do do the right thing don't wait for these lawsuits come come down on you you're just going to leave a bad Legacy in your leadership here in Carl's bed no one wants to see that no one wants to see the kids suffer so just do the right thing please thank you thank thank you next caller is Stephanie Wells uh 9669 good evening my name is Stephanie Wells and I have two students in the district first I'd like to thank the district for following science in putting in place strong mitigation policies to

028keep our students and staff safe in the classroom we are fairing much better than my friends in States like Florida and Texas where entire schools have been shut down after being overwhelmed with Co cases the vast majority of carlbad parents support you and are pro-science pro community and pro public health and last night an overwhelmingly majority of our state said no to eliminating pandemic precautions and the dangerous wave of covid-19 denialism in our state and more importantly we said yes to an agenda rooted in science equity and a belief in the common good while there may be a small vocal group that does not believe in that public health is important the majority does now it's time for leadership to lead and not rest on their Laurels or be distracted by conspiracy or grifter driven

029groups we have adult-sized problems to deal with no time for petulance or ignorance California leads the nation with the lowest covid case rate and our students are backed together in the classro let's keep it that way by continuing to follow the science and guidance from professional who do actual research for a living hopefully you saw the post on the California Department of Education page congratulating San Francisco Unified where there have been no covid outbreaks in schools since students and Educators went back in the classrooms on August 16th M that 9% of children ages 12 to 17 are fully vaccinated vaccines and masks work if they're wearing the correct mask getting all eligible students vaccinated is the right thing to do and the best defense to protect our children and the community thank you for all

030you are doing and please know you have the support of the majority of our district thank you and have a good evening thank you our next caller is Marie mfor uh 6087 I don't see her on the line okay um and then the next caller is uh JB Scranton number I'm sorry was that the caller I'm sorry I thought I heard someone come on so um JB Scranton 2355 and Then star six to unmute please are we on the record yes go ahead Madam chair may it please the board JB Scranton San Diego's number one sub and foster parent and I do not reside in the district I have two children in California Public Schools Madam chair your July 30th and August 11 board meetings were undertaken to evaluate Ben Churchill's job performance these were

031both closed sessions following three points May assist you in rendering an unsatisfactory evaluation of Ben Churchill's employment one Ben Churchill's not accomplished anything significant in his five years at carlbad Ben touted technology is his pet project to improve our schools when he started carlbad has great technology carlbad has the best classroom technology of all the districts I've ever worked with it was excellent before Ben Churchill arrived what Carl's Bad needs most to improve education is reduction in student to teacher ratios this more than any other gimmick will improve outcomes for our students charlesb has great teachers and we need to hire more of them further has Ben ever considered taking the staff of every special day classroom out for a really nice dinner or a beach day have any meaningful ini initiatives such as these

032two come out of the superintendent's office in five years even more specifically are there any objective criteria to be met in order for Ben Churchill to continue in his present position will the public ever be told about these criteria will the public ever be told how Ben Churchill satisfies these criteria two Ben Churchill was not well qualified to be a superintendent to begin with he's never taught in California Public Schools he was not a pupil in California schools indeed the first time he was credentialed in California is when you hired him five years ago furthermore Ben is not a doctor and it is pretentious and inappropriate to refer to him as such Doctorate of education is a sham degree the only people whom we should refer to as Doctor Carrie prescription pads the online diploma

033Mill where he got his Doctorate was shut down number three Ben Churchill is grossly overpaid he's been depleting the public treasury at about a third of a million dollars a year let's expose one of the dirtiest secrets in California public education people go into administration because it's a getrich scheme heard the argument that you have to pay top money to attract top talent this is a phony explanation Talent you need to attract is the talent in the classroom incentive for going into educational leadership should be the honor and privilege of serving the public interest instead it's become a scheme that feather your nest five years he's been awarded $1.5 million we've basically bought him a house so what has Ben Churchill done for us good evening thank you next caller is Scott Davidson number 7181

034my name is Scott Davidson and I'm the parent of a ninth grader in cusd this month is the one-year anniversary of this board's decision to break its promise to open our schools instead of sending our kids back we fought with this board for months to reopen our schools eventually realizing that legal action was the only option as this school year once again starts with rules that will once again keep our children out of school for days and weeks at a time and force them to wear masks all day despite the evidence that they are completely ineffective in a school environment we are once again asking this board to work with us to follow the science and to give our children the best chance to have a normal school year countries all over the world do

035not require masks and have abandoned unnecessary quarantine rules that keep our kids out of the class already we have seen cusd adopt rules which discriminate against unvaccinated students staff and volunteers we will continue to remind this board that vaccination does not prevent infection or transmission and will never eradicate covid so any mandate would be ineffective and in violation of well-established state and federal law we will continue to advocate for the best interest of our students even if that means further legal action we implore this board to understand how fortunate we are that Co is far far less dangerous than seasonal flu for our children whether they are vaccinated or not there is simply no reason to impose any restrictions on them which prevent them from attending school force them to wear masks and only offer

036a few minutes of protection and then ask them to take tests every time they have a running o last year this board failed to properly plan for the school year resulting in continuous changes and moving goalposts that frustrated parents and students and resulted in our schools being closed for over one year remember science always showed that school closures were unnecessary and harmful to Children even though our Public Health officials refused to acknowledge it until we got to court we will continue to present the science that our children are not at risk from covid that on all of these mitigation measures which keep our children from a normal school year are unnecessary we can do this together or we can do this in court thank you thank you our last caller is Scott Diaz number 0816

037good evening trustees um I'd like to thank the board for allowing me to speak today my name is Scott Diaz and my daughter enle Diaz is in sixth grade education at Cal Hills Middle School I also have a son that is in kindergarten at po City Elementary my comments today are regarding the transportation delays within the district I understand the issue the shortage of drivers is one that affects not just the Carl's Bad Unified School District but many within and outside of California and this coupled with the covid situation has made finding drivers even more difficult having said that the way that the district has handled this issue is abysal at best first there was no communication appearance prior to the first day of school regarding the situation to allow for proper planning subsequently I

038have received zero Communications from the district on the situation since the first day of school this is not acceptable keeping parents informed and full transparency is more than a reasonable request there is no sufficient reason why the district has not kept parents informed and engaged throughout the handling of this issue second this is not the first year that we have experienced Transportation issues I went through the same situation last year with the lack of communication and transparency regarding the inability to schedule drivers and routes prior to the first day of school third the district has offered no options or Alternatives given the situation I have not been involved in School District Operations I have not encountered this situation outside of my experience with Carl's Bad unified regardless as someone that has over 20 years of

039management and business Consulting experience I can tell you that coming up with Alternatives is Paramount to solving any problem I would expect the district to offer Alternatives such as staggering the bell schedule to make it easier to pick up and draw off kids with sign liability waivers diverting some of the funds to other options such as electric scooter bikes or um scooters identifying alternative types of providers such as kids jet or hop skip drive or facilitating a carpool system with parents these are alternatives that I have identified with about 30 minutes of thought invested and I am sure that there are many others to offer skin in the game I'm willing to volunteer my own time to make sure this situation is not handled the same way ever again as a full-time single parent working

040a full-time job I too am very busy handling a multitude of problems regardless I will make the time to fix this issue and I can guarantee both the board and the impacted parents that this situation will not be handled in the same fashion plan for unexpected problems providing contingencies for so-called known unknowns is effective and efficient leadership and management and I hope that the board will take me up on my offer once again thank you for allowing me to make public comments thank you this brings us to the end of oral Communications just want to make sure uh okay moving on to item 6.1 approval of consent calendar all matters listed on the consent calendar are considered by the board to be routine and will be enacted by the board in one motion there will

041be no discussion on these items prior to the time the board votes on the motion unless members of the board staff or the public request specific items to be discussed Andor removed from the consent calendar trustees are there items to be pulled yes uh uh trusty Rawlings and then truste Williamson uh thank you um I was going to pull items 6.15 through 6.17 and I pulling in addition to those also items 6.12 13 and 1413 and 6.14 thank you trustees any other item to be pulled thank you um may I have a motion to approve the consent calendar with exception of items 6.12 6.13 6.14 6.15 6.16 and 6.17 so moved Williamson thank you and may I have a second second roll I'm sorry I heard trusty Williams so that was a first with trustee

042Williamson and a second with truste Williams Miss Garcia will you please call for a vote truste Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes truste Jones yes thank you um starting with uh let's see in descending order trustee willamson can you address do you want to address the 6.12 .13 and 0.14 separately or as a together okay go ahead okay um I move that we approve agenda item 6.12 one one 6.10 11112 and 13 with the following modifications all parents I'm sorry uh just for clarification I had only written down 6.12 through I'm sorry I'm sorry one two 13 and4 I apologize okay great yes um I um with the following modifications all parents first all parents chap rones must take a covid-19 molecular PCR test within 24 hours of departure and

043show proof of the negative covid test prior to attending the trip second the coaches must assure all students and parents that the trip is completely optional and that the team members who don't attend the trip will in no way be penalized and third parents will sign an acknowledgement that they understand that if their child is identified as a covid-19 close contact it is likely that they will need to fully quarantine at home for at least seven days second sh shall I explain my rationale yes so now that we have a motion and a second um board discussion um I think that we all agree that our students should have the opportunity to learn in person in the classroom this is the lens I look through as I consider agenda items that come to us knowing

044how transmissible the Delta variant is um I question the risk benefit of the sports teams participating in tournaments that take them out of school for an entire day or day and that greatly increase the chances that they will be exposed to covid in such a way that they will need to quarantine for at least seven days however since I have repeatedly asked staff not to make rules that are stricter than what is mandated by the state and County I recognize that it's somewhat inconsistent for me to then vote to prohibit an activity that is allowed by those bodies so with the conditions that I included in my motion I will will be voting yes on these agenda items any other discussion trustees Miss Garcia could you please read back the uh Amendment for the trustees

045yes one all parents chaperon must take a covid-19 molecular PCR test within 48 Hours of departure and show proof of the negative covid test prior to attending the trip two the coaches must assure all students and parents that the trip is completely optional and that team members who do not attend the trip will in no way be penalized and three parents will sign an acknowledgement that they understand that if their child is identified as a covid-19 close contact it is likely that they will need to fully quarantine at home for at least seven days thank you with that uh any other board discussion trusty Williams I noticed you did not mention coaches just right now on the on the um consent it just states that all students will be traveling M they will take a

046PR PCR test within 48 hours so your requirements are a little bit different in terms of right it it adds the parents and chaperon okay so and this includes coaches as well since they'll be chaperons correct okay okay and then you're you're mentioning 24 hours in advance and on the consent it states 48 Hours sorry I I meant to say 48 Hours okay I wrote 48 from what Miss Garcia read read back I think I said I think I said 48 okay I heard 24% it's fine if if it's if it's at 48 okay justy Pearson um I'm not sure who can answer this question president Jones but is there a current protocol in place that would fall under all three of these activities or trips as it relates to covid-19 uh you could direct

047it to staff thank you and I would direct it to Dr Churchill I believe Dr NY yeah I was going to say I'm sorry trusty Pearson I'm not sure I understood the question so maybe you could rephrase it again and Dr NY can take a stab at it are there any current protocols for any of these three trips that prevent um any transmission of covid-19 well they're C they're certainly using similar protocols that we have in school so they're masking while they're indoors they're trying to socially distance when when they can some of these Sports don't allow for that during competition um but um they're they're doing everything they can when we talk to the coaches to eat meals outside uh eat meals socially distanced um so they're they're trying to follow as many protocols

048as possible to keep students safe and to help uh reduce transmission for sure but parents and coaches are not tested before these events uh this would require uh per uh trusty Williamson any chapron that attends would be tested that is correct trustee Rawlings um yes um is there any cost to either the um uh the district Andor the um the individual when it comes to tournament fees um and other um fees to participate in these events and are those fees potentially refundable um if um there is somewhat of an out a CO outbreak uh there are typically um costs associated with you know Hotel fees um if they're staying overnight um as well as um you know meals that they're eating um and entries some entry fees into tournaments depending on the tournament um all

049of those you know could be refundable depending on how those are reserved so yes and are those paid for through boosters or how how are those paid for or is it individual uh traditionally they're paid for through either boosters or donations um we we um do not exclude students for failure to pay in any of these so that's clearly delineated as well any other questions trustees seeing that there are no other questions Miss Garcia will you please call for a vote trusty Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you uh let's see may I have a motion uh let's see for item I'm sorry for item 6.15 and through 6.17 um both truste Rawlings and truste Williamson pulled them um let's start with you truste Williamson uh

050I would like to make a motion that we approve agenda item 6.15 6.16 and 6.17 with the following modifications first parents will be made aware that YMCA staff are not required to be vaccinated or to test for covid and two parents will sign an acknowledgement that they understand that if their child is identified as a covid-19 close contact they will need to pick up their child from camp and that child will likely need to be fully quarantined at home for at least seven days thank you uh may I have a second second thank you and then discussion I guess the question uh do before you ask trustees uh Dr Churchill when we have two trustees looking for similar items we can't take a vote on this item or do should we have both trustees address

051well so you've got a motion on the floor in a second so now it's in trustee now it's in discussion so uh all five trustees can kind of weigh in um at some point you'll have to call for the question to be voted on as uh as motioned and seconded okay so uh would it be appropriate to have trustee Rawlings if there is I'm not certain you know obviously um if there's an amendment or questions about the item but could could we make an amendment in in this item if we have it open at this stage or we would go through truste Williamson's first and second and take that vote and then bring the item back again you certainly could uh depending on where the discussion goes someone could ask trusty Williamson to modify her

052her uh her motion her motion okay get that point so yeah kind of see so let's have trusty Rawlings begin thank you um I will still be uh voting no on the three items um reason being um uh if we look at Julian for instance my understanding is is that there is not um Health Care Professionals such as uh nurse Andor um Physicians on on site and Julian is um significantly far away from um medical facilities um and in addition um if there is a quarantine uh let's say somebody needs to quarantine for or a student needs to quarantine uh prior to leaving uh there is uh not a refund of those dollars that have been U put forward as well as if there was a partial if somebody had to be if a student

053had to be quarantined and have to leave they again would not be quaran or they would not be reimbursed um the money that they've uh put forward um in addition um I'm also uh concerned about the um uh as many parents that may have to come and pick up students um if the need for uh quarantining and close contact so um I'm not convinced that um these trips as uh trusty Williamson alluded to that are necessary um for Learning and education and therefore I'll be uh not supporting these three items thank you trusty rowlings uh did you have your hand up trusty Pearson I did um thank you president Jones um so Dr NY I'm G ask the same question I did before if you could U review the co9 Delta variant prevention protocols for

054all three of these camps yeah there's a whole list of protocols that the camp has provided um everything from cohorting of cabins together to eating arrangements to um masking indoors and Outdoors um certainly a lot of uh sleep when they're sleeping in the cabin they're um they're uh reducing the number of campers per cabin so that they can socially distance uh six feet apart um so there are a number of different mitigations they've tried to put into place um and so those those were included obviously I believe uh in a previous communication thank you thank you I have a quick question uh Dr NY and just to reaffirm these trips are optional for all students so if there were concerns on this part uh yes 100% option and the followup was parents have been supplied

055all of the details for the various protocols that have been approved by the local uh Public Health that is correct yeah for aiera Oaks Middle School they're the first school going and and they're going in a couple weeks I believe so they've been provided uh that information and and both Cal and Valley have have uh the camp just recently updated their information so they've if they haven't communicated it out they will be communicating out shortly thank you can staff assure us that they will be communicating that to parents in some form thank you yes trusty Rawlings I was also going to say based on the time frames I would be willing to reconsider my vote uh especially the December and November depending upon and March uh depending upon where we are at in the pandemic

056thank you trusty Williams thank you I I I um I understand your concerns trusty Rawlings but if based on this motion to notify all parents to note that the YMCA staff are not required to be vaccinated or tested and if they're aware of that and acknowledge that and they have an opportunity to an option to go or not the students to go or not go that's where I I will support um what trusty Williamson offered in terms of at least the notification so that's so I understand your concerns but if their parents are aware and notified and signed an acknowledgement I will support that for those students to go as long as they notified my question to staff is the next Camp the upcoming Camp is next Monday the 20th of September does this give

057enough if we approve this today does this give enough time for staff for parents uh for staff to give parents those notifications before prior to Monday since today is Wednesday yeah it's the following Monday it's not this next Monday it's the Monday after next so yes I believe we'll have time to I have I have the September 20th which is this coming Monday yes that's correct so the question is do we is that give enough time for staff to make sure that these are sign we will we will get the notifications out uh tomorrow we'll work with uh principal flowers thank you any other questions or discussion trustees seeing that there is none Miss Garcia will you please call for a vote or actually before you call for the vote will you please read the

058amendment back so the trustees can hear it one parents will be made aware that YMCA staff are not required to be vaccinated or to test for covid two parents will sign an acknowledgement that they understand that if their child is identified as a covid-19 close contact they will need to pick up their child from camp and that child will likely need to fully quarantine at home for at least seven days okay trustees Miss Garcia will you please call for a vote trusty Williams yes trusty Rawlings no trusty Pearson yes trusty Williamson yes trusty Jones yes okay I believe that brings us to the end of the items that have been pulled which brings us to item 7.1 uh it it should um ah sorry Tongue Tied tonight public hearing sufficiency of textbooks and instructional materials

059for 2021 2022 school year um for this item I'm going to introduce Dr NY um assistant superintendent of instructional Services thank you president Jones staff has ensure that the district is in compliance with Education Code 60119 for sufficiency of textbooks or instructional materials align to the state adopted Frameworks a copy of the district's list of the 2021 22 approved textbooks is attached for English language arts mathematics history social science science World Language and health as exhibit a so staff will turn it back over to president Jones at this time thank you Dr n this is the time in place designated for the public hearing to assure the availability of sufficient textbooks and instructional materials I declare the hearing is now open have any written comments been received from any person as to these proceedings or

061have lost the year of learning a July 2021 study on top performing schools ranks California 41st out of 50 states yet we have curriculum politically indoctrinating our children with implicit bias tests ethnic studies that condemn Christians that teach worship to Aztec gods and now social emotional learning also known as seal which uses the textbook on the list called positive prevention plus a sample from this textbook for elementary age children I quote from it on gender and sexual orientation Define sexual orientation is the Romantic attraction to someone of the same gender or a different gender again this is for elementary age children for middle school children the topics in the same book positive prevention plus are lgbtq plus bias identify and accept diverse gender presentations and sexual orientations lesson six has accessing accessing contraception listed as

063schools leave child formation to the parents and let our teachers focus on reading math science and civics stop this immoral and political indoctrination thank you seeing that there are no further comments I declare that the hearing is now closed do the board members have any comments they now wish to discuss regarding this item we will now move on to the next agenda item and we'll consider the sufficiency of textbook instructional materials for 20 2122 uh sorry 2021 2022 later on in our agenda thank you which brings us to item 8.1 2020 2021 unaudited actuals trustees this is a discussion action item and for this I will turn it over to Mr Dill thank you president Jones and good evening trustees from the spring of 2020 to this June the board formally reviewed the budget six

064times the 2020 2021 budget six times now that that tumultuous year is over the books are closed and this evening we present the UN audited actuals report everything up to now was a spending plan what you're looking at tonight is reality and a recounting of what actually happened in a normal year each iteration of that spending plan will come forward with some minor differences last year however as you all know was not a normal Year from the proposed budget to un audited actuals starkly different planning factors were used and they were based on the best information at the time the planning factors in January May June July August and Beyond were dramatically different each month and throughout the year the district adjusted the spending plan based on what we knew within the means we had

065it uh we had available to adjust uh and address I'm sorry tongue tied and address the challenges of the Year each of those plans were a reaction and not an overreaction and those are my observations coming to you as an outsider uh both as an experienced CBO and somebody who performed fiscal oversight of districts at a county office um you know I think that that you had very solid plans throughout the year and we ended up in a different place the credit goes to you board the superintendent and my predecessor for for maintaining that stability so before I begin uh with my presentation let me introduce one more person to give credit to and that's joining us tonight is our new director of fiscal Services Miss RSL Salazar Miss Salazar joined us in August and

066she oversaw the closing of the books for last year this is a daunting process every year and it's no easier when you come in and you're closing the books on a budget that was developed by somebody else and she led that work and took her staff through that the end product is high quality and it's a accurate report of our financial activities for this last school year so I'd like to thank and recognize Miss Salazar who's with us tonight and her team for a job well done so I I do have a brief presentation after which I'll entertain any questions that you have and then I will respectfully request that the Board of Trustees approved the 2021 un audited actuals financial report the proposition 30 education account expenditure report and adop resolution number 10- 2122

067which sets forth the 2021 and 2122 Gan limit Appropriations so I will now share the screen there we should have up on the screen so as we go through the UN audited actuals the main four themes that we have here uh is that we inched into basic Aid in 2021 uh that funding source uh you know came in at the end of the year and as we recalculated our local control funding formula uh we we just barely made it over the line into basic Aid and I'll talk a little bit later in this presentation how flipping in and out of that status is likely over the next few years and the factors that we're going to need to have our eye on as we look out into the future uh when I look at the

068expenditures we captured our savings at the end of the year in the in the normal ways uh of closing out purchase orders and uh closing out budgets uh and so it was a very normal closing uh process in which we saw uh savings throughout the district the onetime covid funds we'll talk about that a little bit later on as I mentioned as we were adopting the budget uh the revenue that we receive is receive received in one year and it's meant to use over multiple years and I've got a slide that shows that so that can create the perception of an imbalance or a perception of a deficit when you get all the money in one year and you spend it the next and so I'll help walk you through where we are with that

069but when we look out over uh a period of time we do have balance in those onetime funds and so we do end up with the with the modest Surplus and that improved fund balance will help provide additional stability to the district so the very high level summary uh of where we are with revenue and I'll take you through each one of these categories compared to where we were at estimated and where we landed with actual expenditures um the first thing that would probably jump out at you is it appears as if we have less Revenue than we projected at uh at the estimated actuals that's very explainable and I'll explain it in just a moment uh expenditures we did capture some savings and then showed the uh the change of just a little over

0701.2 million uh additional in the ending fund balance than we had projected uh just a couple months ago so this is very similar to a slide that I showed you at adopted budget which shows the revenue and expenditure history uh as you can see we have a a very good track record of you know of Revenue and expenditures being very closely aligned uh you know in a perfect world dollars in would equal dollars out every year and there'd be a little bit more uh than next year but we're not in a perfect world and so sometimes we're a little bit more on revenu sometimes we're a little bit more on expenditures the trick is to be kind of skipping like a stone across a lake and not uh skyrocketing and plunging uh when you're looking

071at the difference between your revenue and expenditures so this is a very stable profile uh When I Look Backwards when we get to those last two columns with uh what is now the 2021 on audited actuals uh you do see that uh increase in Revenue as I as I mentioned during the budget adoption process this is primarily due to uh an influx of one-time Revenue that we receive at the end of the year um that was meant to be used for this school year so Revenue a little bit higher last year expenditures a little bit higher this year there will be some adjustments uh that we're going to be making it first interim and I'll also talk about how that uh that blue bar on the uh the current year budget you know we'll see

072that go up my curse is in the wrong place okay un audited actual Revenue uh as I mentioned with uh property tax we've received more in our secured role and in our Redevelopment agency Revenue which is a form of property tax than we were anticipating we were tracking uh right on target all throughout the school year uh and so the revenue we were receiving looked exactly where we were uh budget wise um but as we got to the end of the year with those final apportionments where the the county TRS us up with what's actually been received versus what they've already given us um we saw that that influx of Revenue and the the the the bigger amount uh was the Redevelopment agency Revenue so that actually uh it increased by $800,000 and we ended

073up being basic Aid by $400,000 approximately so it really was that piece of uh of of unexpected Revenue that that pushed us over the top there are many different uh categories in the local control funding formula that all add up to those sources and so there are a number of adjustments that went back and forth um and in the end we ended up with uh just about 1% more uh than we thought we were going to have on the state revenue let me point that out because you see a drop there and uh I would really characterize that that is a drop overnight uh when we adopted the budget and when we were planning uh estimated actuals uh we had funding from the expanded learning opportunities Grant it says in person instruction Grant here it

074was ELO uh I'm sorry different ab86 uh Revenue Source um we had that Revenue recognized in 2021 that's the way we were told to do it uh and then as we were closing the California Department of educ ation gave districts new instructions to count those dollars in the 2122 school year so we had to pull that out of uh our un audited actuals Revenue we will be building it back in this year so this is you know really on on June 30th even though we had it we didn't we couldn't count it on July 1 we had it and we count it so you'll see that come back and we'll we'll build that um approximately $3.2 million uh into the budget so on lcff components uh this is uh just a repeat of the slide

075I showed in June uh with the actual uh included in here and you we were close uh with uh where we were with property tax and very little in state aid now this year we were really down to the minimum state aid and that's a vestage of the the transition to the local control funding formula where every District had at at least the minimum that they received uh in categorical funding uh prior to that so that's what we get now at least for for this current school year um the education protection account when you're basic Aid uh that sits on top of your property tax and so that was one of the adjustments that we made the um when you are an lcf District that is part of your state aid so that's part of

076the back and forth adjustments that we had so as we look out into the future on our stat status of do we remain in basic Aid or do we go back to local control funding formula and back to basic Aid potentially in the future um there are a lot of things to to keep in mind um one is when we build in our estimates for property tax in the current fiscal year it is based on the Assessor's tax role of December 31st of the prior calendar year so it's about six months behind uh when we when we adopt the budget and it gets adjusted uh one more time uh before the end of the year and so you're you're you have to take into consideration what happened in calendar year 2020 that would impact our

077property tax revenue for the 2122 school year and as we know the property tax Market uh or the property Market was seized up and Frozen for a while during covid where there were no real estate transactions uh people were afraid to move uh or to even sell their homes uh for a period of time so a lot of uh slowdown in that market so we didn't see as many sales happen um and it did slowly thaw out near the end of the year but not to the extent that we have right now the um so when we adopted the budget for this current year uh we did have a a very restrained and you know pulled back uh estimate on our property tax revenue growth for this year um which was a a one and

078a half% and that was based on the assessor saying the tax roll as a total in your District only went up by about one and a half per. we'll get a new uh property tax estimate in the fall and then we start this whole process back over in the spring when we start looking at 22 23 so you know when I look at the uh in the previous years you know we're in about a a similar band every year in terms of Total Property tax uh increase you know we did have a spike uh one year um but that big drop you know it's it's not just Eric being too cautious and too conservative it really is based off of the Assessor's estimate on the on the um property tax or on the on the

079assess value so you know there is some grounding in that number and if it goes up during uh during the year if we get revised estimates you know we'll we'll adjust that upwards but right now that's the best estimate that we have so how can we flip in and out well if we only entered basic Aid by $400,000 Which is less than half a percent uh we end up at our lcff entitlement and our property tax revenue for last year in about the same place now recall what you see in that big drop on the Orange Line there we had zero funded Cola on the local control funding formula in 2021 that was the Compromise instead of cuts um to education that we were responding to at the beginning of the year but we went

080through the entire year without an increase in the local control funding formula we get into 2122 they not only make up the cola that we missed out on last year but they include the funded the statutory Cola for this year and there was uh additional percentage on top so the local control funding formula goes up by quite a bit this year um but our property tax we estimated at 1 and a half% um that was the estimate we got from the assessor in June of uh of this year um in July uh He adjusted it upwards to 3% I'm going to wait until I hear from the auditor controller's office on their estimate on property tax before I raise the the estimate on property tax but just know that the assessed value estimate did inch

081up a little bit after we adopted the budget so this is you know the the main factor the cola uh the increase in property tax um but then we have to look at our average daily attendance and how that factors into the lcff calculation so you know will we remain uh somewhat flat will we grow will we dip you we have to pull all those factors in and this is the exact same slide that I had at adopt budget uh there no changes here uh for 2122 uh we came in in the middle of our um two previous enrollment projections uh studies and we're we're right at about where that that green bar is we're not quite up there yet um but we're just a little shy of that kind of compromise in the middle

082so I think we need to do a little bit more evaluation and fine-tuning of where we are in terms of enrollment this month and as we get ready to report that information to CDE next month and that will help us inform uh our enrollment projection for next year we'll also do another demog graphic study as well so we'll have a number of different factors um plus as we receive enrollment uh information from our school sites um to help refine what the lcff calculator will look like um for each of the upcoming budget reports this year so we're going to be doing a number of recalculations and probably multiple scenarios looking at uh our tolerance for going back in or or or um staying in basic Aid so getting into the expenditures as I said this

083is this is pretty routine in terms of the the very slight variances from actuals to uh uh from estimated were right in line of of where we thought we would be um so I say this is this is mostly routine and and mundane and and not much to to Really point out here um so when we get to the general fund balance uh left side is unrestricted restricted and combined estimated and the right side is what actually happened and you know as we did pull forward with uh some additional revenue and the savings captured uh we end up with on the unrestricted side just a modest uh surplus of 2.4 million so another way to look at that is that's uh that's about 2% of uh the unrestricted budget so you know we met even

084with this additional Revenue that came in near the end of the year we spent 98% of what we received on the unrestricted side um and that's about as close as you can get to balanc without being you know spot on and we have the number of different components in here as well so a quick uh recap on our covid relief funds we've received uh a number of different sources over the last few years um of varying dollar amounts with different timelines on when they can be spent and how to spend those what I will say is everything that has that we've come up against the expiration date uh We've exhausted all of those funds prior to the expiration date so we put those dollars to work as quickly as possible uh for all the additional

085Services uh Personnel equipment supplies uh that were necessary to address the pandemic and return to inperson instruction and also to support remote learning when we were in that model as well as hybrid um so those dollars were very welcome to address all of those extraordinary costs and uh and we made good use of those particularly in the 2021 school year uh I I put a a dark line there and and you know that's really the the dollars that we received and have expired already then we get down to inperson instruction expanded learning opportunity in sr3 which we haven't really had a chance to talk about yet with respect to in-person instruction and expanded learning opportunity at the time uh those dollars were granted to us in ab86 uh they had an expiration date of September

086of 22 and so our district and many others quickly uh built those into the budget and as Dr Churchill mentioned earlier today when he was showing his infographic all of the additional supports that we put in uh for expanded learning opportunities uh hiring additional um support staff tosas uh counselors um we've continued to hire additional custodial support health technicians you know just across the the board actually I think I mentioned them in the next Slide the number of things that that we've used those we put them all in the budget for this year under the assumption that we had to essentially use all those funds by the end of the year subsequent to that CDE extended the deadline for those funds which is a welcome thing um because if we somehow are not able to

087use all those funds prior to the end of this year at least we will have the ability to carry it over and and use in in future years through 24 um you but I think the Assumption right now is we're going to use uh we're going to use those dollars because we built them into the budget we've hired a number of people and and also set those funds aside for a number of different activities and then we have sr3 which um we we know we will be receiving 7.4 almost 7.5 million there is an S3 expenditure plan that we will be bringing uh to the board next month so let me talk about that um as I mentioned with the expanded learning opportunities plan uh Dr NY presented to that uh that to you in

088May and we use that one-time State funding for a number of supplemental instructional uh support Strate uh strategies so we expanded summer school we had a very large summer school um we brought in intervention teachers tutoring assistants read 180 sheltered sections Etc the gear classes you know those are all examples of things that are in that expanded learning opportunities plan now SI since we do have all of that in process right now um you know we will exhaust the state funds at the end of this year and uh as we look at those activities I think that there is a not only a desire but a recognition that we will need to continue some of those activities into the following school year and so uh what I would recommend to the board is that we

089reserve sr3 in this current year and use those dollars to extend the activities of the expanded learning opportunities plan into the 2223 school year and we would write up the expand the sr3 expenditure plan essentially to model or mirror um the ELO plan that you've already approved and then uh you know we what we will need to do is is look at um you know to make one I know that the the funding source uh can cover all of the activities of both inperson instruction Grant and the expanded learning opportunities Grant um however those two are slightly more than uh what we would have available under sr3 so you know we will have to look at are there some things that we will no longer need to do in in the next school year start

090pulling those things out out um and fit everything into um into the sr3 plan plus we've got some additional funding sources that can cover those gaps as well that um that will be coming out of um the state budget that you'll see at first interim so that would be the plan uh for sr3 uh and then we will bring that to you at the next meeting so this is just I'm not going to dwell too much on this but just wanted to put it in the the presentation uh not not only is there the general fund but there's the special funds uh fund 8 is a new fund for this year we're now required to uh report the uh rolled up summary activities of the associated student bodies so you'll start to see those in

091in our annual and actual budget reports uh and uh our cafeteria uh program did well last year with the number of meals that were served in the efficient way that we were able to do that and uh that Surplus will come in handy as our costs are really going up with supply chain disruption that's continuing into this next school year so that will help um You Know cover any gaps uh in that program in the uh the capital funds I know the board's fully aware of where we are with our bond funds having issued bonds uh in the spring and then also just report on our developer fees and cfds so next step as I mentioned earlier uh we need to evaluate our enrollment and also uh ensure that we have short up our unduplicated

092count for this year um so that we have an accurate projection on our both our base and supplemental grants for this year and the out years uh we'll bring back the sr3 spending plan in October and then we have a lot of work to do by December 15 uh and that is to uh receive a new property tax estimate from the county incorporate all of that additional State and uh federal revenue and uh run a number of different scenarios um that will help us uh project our lcff versus basic Aid funding status for this year and the next two to three years so I'm going to leave the presentation up on the screen in case any of you ask me to go back uh to any particular slides but I'm ready to take any questions

093that you might have thank you Mr D uh trustees questions for staff and thank you for this and welcome um our we're so glad to have you on our team if you're still with us oh she go until I'm done oh okay good welcome welcome aboard only she can answer okay great um let's see let's start with truste Pearson so Mr Dale I'm sure you're aware of in the city of Carl's B they're going through the revised H housing element and uh some of the requirements by the state of California in terms of what our housing stock how much of it has to be um in for those you know who affordable housing uh that but the the kind of the bottom line as I understand it is we got to have more housing in

094Carl's bed so and and there's the process is we in carlbad so um I just like you to comment on because of that process how that impacts um the Delta between the the analysis we get from the professionals versus what's really happening in the city of carlbad and how that impacts our future enrollment certainly uh the demographers uh do keep on top of uh changes in zoning uh they look at General plans they also will have discussions with um with cities um to check in with okay what developments do you have in your pipeline that you're aware of they they will call developers who are in that permitting process and say okay you've got your permits in hand are you really going to build this uh and and you know because you get a window

095when you can actually start construction and so they will actually reach out and um and say is this going to be sooner is it going to be later um so that they can build that into their model when they will will actually start seeing those residential units come online within each of our attendance areas and then each of those different types of housing units has a different yield factor for the number of students and it's you know it's a statistical model um you know where they will say you know a single family home you know might have a generation rate of you know3 students per house uh whereas a a multifam might have a 02 or you know something lower so you know the the housing you know the more dense the housing um the

096fewer students per unit that we tend to see because those tend to be apartments or uh condos smaller places and they might be more starter uh homes uh for younger families and not necessarily you know where you've got a bunch of teenagers and you know multiple kids living in a in in a you know two to three bed bedroom condo so uh they take all that into consideration and it's and it's based off of you know years and years of history and reality but um you know I do know and having spoken with many demographers over the years you know that they're constantly revising those yield factors and they can even drill down to a local yield Factor if they can determine that you know one city tends to have more students in a type

097of home housing unit than another they can make those adjustments as well on a local Factor very quickly just to follow up on that is there how accurate is their modeling and how accurate has it been modeling for us here in carlat you know in general and I've worked with the the major firms in California and the last three districts that I've been you know they they are pretty darn close usually having said that um my colleagues and I don't put a lot of faith in the most recent reports and when when I you know it's it's it's an indicator but it's not as reliable because so much was going on um in the 20 well the difference between 2019 uh you when all of the data they collected and then you had the that

098was your 2020 report and so you know there was a big shift there and then as you got into um the uh the next school year part of their model relies on what they call cohort progression so they take the number of kids in a grade level and they roll them up to the next level and roll them up to the next level and you've got some drop off and some move in you know there's a lot of ways that they they you know carve up those numbers well with enrollment down across the state the cohorts are smaller and so how do you build that out into the future are they coming back or not um you know it was too early for them to really get ahead of that in their model so you

099know that's that's why I look forward to the next one just to see okay I think I'm throwing out our most recent one it was interesting but not all that reliable but I'm not as optimistic as the previous one I think this one will be a little bit closer to the situation that we're in now thank you thank you thank you truste Rawlings thank you um on S slide 12 um Mr D you you stated that um you felt that the um the difference between the estimat and the actuals was pretty spoton um do you know what the difference is between the uh budget projection and the first interim and the second interim and the ending balance for this year um you know uh I I don't have that off the top of my head

100but you know what I will say is as I mentioned in my opening comments this year the planning factors changed so dramatically from month to month um that each one of those budgets was a reflection of the reality that we were in at the time um and we honed in on it you know closer and closer as the year you know came along and that's why estimated actuals is not that far off from the um the actuals and I the number I have is about 6.2 million between adopted first interim second interim and um uh so what I'm hearing you say is is that because we received so much additional dollars and that we we weren't spending it that that's why there would be such a difference between adopted and um ending fund balance for

101uh the uned actuals for this year is that correct well you know the on there there's two stories here and one is the uh unrestricted and the other is the restricted so you know unrestricted which is mainly fueled by the local control funding formula um you that really didn't change in terms of the total revenue estimate through the year and you know in the end on the unrestricted side um you know we were we spent about 98% of what we received on the restricted side that's where you do see um the additional categorical uh restricted covid relief funds uh coming in many of which you know counted towards the revenue was recognized in the prior year but eligible to be spent over uh over multiple years uh and so that's that's why you do see

102a a larger uh Surplus on the restricted side both of those add up to the the U actual combin I had a follow up to that thank you Mr D the the question that I had was did in in the amount of money that we had to sort of flip the switch on and move it to another year overnight did we have have planned expenditures against the 2.76 million that we also moved into the year and so that's why the figures are fairly similar in expense and revenue so those expenditures were already built into this current year uh because at the time we we we knew the revenue was coming and and the way that we were instructed by CDE was you know count this in the 2021 school year but it's really meant for

103your expenditures in the following year and so that is where that imbalance uh you know on that bar chart that I showed where you know and it was even more pronounced at adopted budget where we had way more Revenue in 2021 than expenditures and then it flipped because we were using that Revenue in this current year and so the same so the same follows but I will say on that bar chart I haven't updated the revenue yet so so it still shows the Gap um but that UMX proximately 3.2 million of um ELO dollar will get added to that blue bar it's going to close the gap between revenue and expenditures um and and I'll and I'll do a good hope I was gonna say I'll do a good job I don't know if I'll

104do a good job I'll try to do a good job of explaining all of this at first interim of the the new sources of revenue that came out of the state budget the Sesser $3 that uh we will be recognizing uh you know coming in this year and how that Stacks up against our ongoing expenditures versus our one-time expenditures addressing this um you know with with the sudden movement it was a little too complicated uh story to tell uh for this night but with so many changes you know I feel that I need to do that at first interim so you've got a good picture thank you and I have a followup to that um trustee person so hopefully you'll indulge um uh Mr D do you estimate that if we kept everything that we've

105added thus far uh are we outspending the sr3 allocation we have by a modest sum a large amount or I know that may be a preview of the next presentation you're going to give us but um I'm just trying to get an idea yeah if we were to only look at the expanded learning opportunities plan you know which was about $7 million and compare that to the 7.4 million that we're receiving on S3 you know we would have enough in sr3 to cover everything that we're doing in Elo um but I'm also looking at the inperson instruction Grant which is about 3.2 million in which we're doing a number of things and that's but we're paying for things that we might not need to continue into the next year um you know the the need

106for you know sanitizers and wipes and those sorts of things declines um you know that we can pull back on some of those things um and then we'll also just look at the other additional um sources of funding that have come in from the state to see if we can cover that um you know outside but I I've really got my eye more on comparing expanded learning opportunities plan to sr3 plan and those are and those are much more classroom Based Services um you know it's actual Services as opposed to to things and ancillary support great and and that's coming in a future report from your team correct so the the s three plan will be at the next board meeting um and then we'll we'll as we're planning our our budgeting for next year

107you we'll look at those things that might not be funded from uh the inperson instruction Grant and see how we can either continue them or not if we don't need to okay thank you uh any other questions trustees seeing that there are none we appreciate it uh let's see we will this since this is a discussion action item trustees and we have uh oh no may I have a motion to approve the 2021 2020 2021 un audited actuals financial report proposition 30 education account or the EPA expenditure report and Adoption of resolution number 10- 2122 which sets forth the 2020 2021 and 2021 2022 Gan limit Appropriations Pearson thank you and a second second Williams thank you uh so that was a motion by trusty Pearson second by truste Williams uh board discussion trusty Rawlings

108thank you and um uh Mr Dill I agree you haven't been here that long um so um and I've had um I have cons have expressed concerns about the growing res Reserve um in this district for a number of years and we continually see projections of$ three and4 million we have to cut back we have to cut back yet even during a worldwide pandemic where we had schools closed for over a year as one of the callers pointed out we chose to put money in the bank instead of spending money in order to open our schools and so I'm looking at budget uh projections and um uned actuals from 167 of $20 million and we are now in uh 2021 of almost $31 million um so over time we have continually grown our reserve and

109um and I just don't believe it's being responsive to the taxpayers and responsive to our um to our students that we chose to put money in the bank instead of money in the classroom so I um I will be voting in favor of the um unoted actuals um but I do believe that hopefully we can um uh utilize our dollars to benefit our students and benefit our community uh more than just benefit and Pat our bank account thank you any other comments trustees discussion seeing that there is none Miss Garcia will you please call for a vote truste Williams yes truste rings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you thank you Dr NY and thank you Miss Salazar um this brings us to item 8.2 2020 2021 lcap updated results

110trustees this is an information discussion item and for this I'll turn it over to to Dr NY yes good evening president Jones trustees Dr Churchill tonight we're here to present uh the unreported data based on the summary of progress data for the 2020 2021 school year as as the board's aware part of the summary of progress that we bring to you in June we don't have all the data available for the end of the year uh this is the opportunity now to bring forward some of that data and uh report on it um as part of our continuous Improvement cycle I am joined I'd be remiss I'm joined also by our uh two directors our director of Elementary education as well as director of secondary education directors Aras and obset and they're going to help

111me co-present this as we move through the slides so in the area of goal number one most of these items we reported on are the middle two items we reported on um as Dr churan mentioned our a tog numbers are in for the graduating class of 2021 and those were at about 83% 82.9% um that is the highest they've been since I've been here and that's about 10 years now so uh we have grown exponentially I think when we first came into when I first came into the district those were about 60% um and I know the board uh had made a had made a resolution to U align our graduation requirements with our with the a tog requirements we're one of the only few districts in the state that does that and and as

112Dr Churchill had mentioned we were able to maintain High graduation rates as well as high UC CSU eligibility rates so that is um a testament to all of our teachers uh from the early Elementary grades to all the way up to the high school as well as our administrators our parents and our students that is not an easy task uh one of the requirements to meet a to G is uh through Algebra 2 so two years beyond the state requirement of an algebra uh meeting algebra requirements we require two additional years of math as an example um that's a exponential task and for us to get to that percentage is a a testament to a lot of hard work by a lot of staff so uh the other item on here is the percentage of

113students meeting or exceeding standards on cast which is the California science test students in fifth 8th and 11th and 12th grade take this test we had a Target goal ofh 50% and we hit that goal of 51% for last year so we met those two uh requirements to take a look at uh longitudinal data over some time as we mentioned before um our graduation rates were at an all-time high of 90 98% um the percentage of students meeting adg requirements as we mentioned before 83% um one of the other uh factors that we look at are the percentage of high school students enrolled in at least one honors advanced placement or community college class that continues to rise as well um that's about 18% increase since 1516 middle schools remained pretty flat and um we're

114looking into that you know at 50% we don't know if that's as high as we're going to get the options to take you know Advanced courses at the middle school isn't as robust as at the high school um and we don't have as many students obviously enrolling in community college classes at that level as well so we'll take a look at that and see if we're uh getting close to to a level um where we can exceed one of the areas that we did see a decline in is the area of advanced placement uh we saw a decline not only in uh tests given but we also saw a decline in our Pass rates um we believe it had a lot to do with obviously not having in-person instruction in the case of Sage Creek

115as an example they had to shift many of their pacing guides they moveed from a traditional schedule to a block schedule to accommodate um the uh covid times and some of hybrid schedules and you know so we we think that this is a blip in the radar uh Associated to covid but we'll continue to work with our AP teachers as well as our High School principles to identify any outliers um we're starting to dig into this data a little bit more as well in the area number two these nothing's changed here we presented these in uh June so we met both of those targets and then in area number three uh we had the parent University participation rate already in there we had the S the Coreal and our graduate profile surveys in there as

116well and we will be bringing you our career pathway strategic plan uh in the October board meeting so we think we've met all three of those goals there so overall you take a look at it it's about a 73% uh goal completion rate which we think in in the year that we were uh given we think is very good um we're still getting after some of those academic goals um we think that we showed some good growth in math and English language arts as we mentioned before um and I'll I'll highlight some of that in a little bit a little bit later I'd like to turn it over now to director Aras who's going to walk through some other unreported data as as you know we have a front tab items on our lcap which

117lists the overarching goals but we have some back tab items as well that we like to report on um and director Aras as well as director obset are going to highlight some of those thank you um so we have additional data pertaining to College and Career Readiness um as Dr Churchill and Dr NY had mentioned 83% of our seniors last year met the ucn CSU eligibility requirements Which is higher than both the San Diego County and the state percentages we also had that um 98% of our seniors graduate which again is higher than County and state percentages our college going rate for the class of 2020 was 80% which means that 80% of our seniors attended College the year after graduation we also had a college persistence rate of 91% for our class of 2019

118seniors which which means that 91% of those students actually returned for their second year of college our AP Equity rate for the class of 2021 which is the number of seniors who scored three or higher on at least one AP exam at any point during high school out of the total number of seniors was 48% which is also higher than the state and National percentages um our AP pass rate which Dr and I just covered was 66% and our career Pathways participation was at 62% which was up from 5% last year um and we also had an increase in the percentage of AP exams taken since 2011 which was an increase of 66% uh next slide please uh for the class of 2020 93% met the English language arts benchmarks on the SAT exam um

11984% met the math benchmarks on the SAT exam which was an increase from 79% in 2019 on the ACT college readiness composite score 86% of the students are considered College ready which was an increase from 80% in 2019 and also higher than the county and state averages and I will now turn it over to director Kasha obset thank you good evening so um at elementary level with our achieve uh 3,000 scores you can see it's sort of maintained steady over the past three years so slight dip this year but not any lower than it was two years ago um this is very similar to um the early literacy that we use with with smarty ant so we saw similar results with that you um and then as um you heard earlier tonight as well we

120did offer a very robust summer school program this year um so we had uh several different options um for students at elementary middle and high school we did offer inperson um learning this summer so our students could uh continue their learning make up credits um or make sure that they were prepared for the the next grade level um so you can see the numbers there of how many students actually participated at each of those levels um it was a four-week program for um elementary and middle school and then the high school was uh several sessions to make up their their credits um we also offered um virtual tutoring where we had lessons that the students were able to um engage in independently over the week and then they had a teacher um by grade level

121or subject at the high school level in our math areas um where they the students could connect with that teacher and get um small group assistance once a week and that was for uh six weeks and then for our incoming sixth graders and ninth graders we offered three days of gear up right before the school year year started um where they were able to kind of get a ramped up orientation where they learned about the campus learned about some of the staff that were available and the resources there as well as study skills and and just different strategies um to make sure that they were successful when they did start their uh sixth grade or ninth grade year as well as making those connections with friends so getting that step up of you know making

122sure that they were making some friends and learning um about the school so at this point we are waiting for our star um assessments which uh just opened this week our fall administration of that and we will look at those results um for our middle and elementary students to see um how they performed um the ones that actually went to to summer school um and then you can see some of the data for our high school credit recovery so again from that previous slide we had 430 students that actually completed summer school which um came out to be almost like 750 semester courses that were completed since students um you know completed more than one course um they actually earned back uh over 3,700 credits um just by participating we did have 1002 students that

123did not finish but we have increased um the the sections at the high school and allowed them to to continue doing that um throughout the school year if they wanted to to um make up those credits right now and then the subjects that we had the most participation in was biology world history and then geometry and Algebra 1 we also did a a family survey for the middle and elementary schools um just trying to collect some feedback on the success of the program and you can see those results there so families you know reported that their students you know enjoyed um coming to the summer sessions um the families indicated that the curriculum was appropriate for the levels where their students were at and that it helped them um continue their learning and sort of

124close those gaps and prepare them for the next year um and then um parents also reported that they would recommend this program and if you know we offered it again they would definitely sign up and that was some positive feedback um so then just some of the ongoing interventions that we um have in place um again that increased remediation um sections at the high school again for those students that needed to make up their credits um as well as intervention teachers that we added at all levels to either lower class size provide additional support or intervention sections um such as like the um Math 180 read 180 those sorts of things that at the secondary level um increased our English language development sections to support our English Learners um continuing to use the sundai system

125as an intervention for students that need that at elementary and middle school um we are offering a robust tutoring program um both for students that may be struggling as well as students that are out on quarantine or maybe out um through illness so we have a bank of teachers that have signed up for that as well as we've contracted with Varsity Tutors so that we're making sure that we can address all of those students um each of the sites has um an intervention team where they um progress monitor students using like our star assessment data as well as other data points and you know making sure that students are targeted for interventions as needed um we also with our math tosa this year have created a math resource website um where they are pulling a

126lot of um information like videos and lesson um reviews so that students that are at home they'll have access to um those Concepts online and they can you know go there if they need help with a specific concept or um lesson in in math um and then we're continuing with our subject area leadership teams at the secondary level as well as grade level meetings at at elementary just really focused on um best practices and sharing of those ideas um and that's information that they take back to their departments Andor their grade level teams at the at the school sites um really again just trying to focus on how do we meet the needs of of all of our Learners this year um and then teachers all have their Google classrooms or seesaw set up um

127as well as additional resources that are available for those students that are out on on quarantine and I'll turn it back over to director Aras thank you we are offering a variety of social emotional supports again this year to students we have increased our counseling and mental health supports through the addition of three mental health therapists one at carlb high school one at Sage Creek High School and one serving the three middle schools we added five elementary counselors for the first time which gives more support to elementary students and we continue to teach social emotional skills using Harmony lessons at elementary school which covers communication and problem solving skills social skills anti-bullying and empathy skills we also increased the social emotional lessons at middle school and high school which includes managing stress resilience empathy perseverance

128motivation and anti bullying we will also continue to do lessons to support organizational skills study skills and time management skills as well as digital citizenship and we will also continue to develop and Implement lessons around College and Career Readiness um and exploration which includes identifying strengths interests and values and exploring different types of careers in colleges um and we also that you heard earlier before have our new Pals program the peer assistant uh listeners program at carlbad High School in Sage so we are happy to hear that that is um going well um and we also are continuing to do um some checks on students through surveys um and these will be sent out throughout the year as well um and we continue our social emotional graduate survey thank you sorry about that I clicked

129you off a couple other things that I just wanted to highlight before we open up to questions is that we we continue to use multiple data points to measure growth throughout the year there's site site level assessments obviously those are your teacher common assessments your grades um interim assessments used at the site level but these are a list of um District level assessments that we um use to Monitor and track student growth and triangulate student growth over the year so those continue to be esack testing and cast testing which is your one uh snapshot of the year uh where you are measuring students at a percentage level of achievement uh based on grades um secondly we collect star and Renaissance data we're we're going to continue to do that for year two which allows us

130to grab snapshots in the fall winter and spring for both reading as well as math and we can capture proficiency data there but we also can capture student growth data and we we highlighted that last time and I'll show you a few slides in a in a moment we continue to collect Achieve 3000 data which measures Lexile and something called uh colleg in prer Readiness indicator uh the Math teachers at the secondary level are all using the mdtp which stands for a math dignostic testing uh which really gauges math Readiness uh when they first go into the course so if you're an Al albra student they take the math diagnostic it identifies gaps and skills that they currently have and that allows a teacher to really Target in on certain things and science we're going

131to use um as a pilot this year some ngss aligned assessments as well so all of that makes up for uh you know a number of different assessments that we do throughout the year to really triangulate and measure student growth we we showed you this last year but I I do want to highlight it um because we have some new data that goes along with it but this was the student growth report or student growth percentile that's measured in Star and this one is specific to reading um and you'll see what you want to do is move students from those low growth bands into typical growth or high growth over the course of the year uh in this case we move 3.2% of students into the typical or high growth from the low growth band

132uh in the area reading um from Fall to Spring which shows growth it doesn't necessarily mean that they were at grade level but they were growing um star publishes a report every year that says well how how well did we do in comparison to the state averages as well as the national averages and so prepandemic um median scores is right at that 50th percentile and you'll see here California last year for that growth percentile um the median score was at 44% the national score was at 45% Carl's Bad was at 57% so 7% above the prepandemic typical growth and uh you know obviously 133% above the California state average as well when you take a look at math math we grew 1.2% of students from that low growth band we shifted them into into the

133typical or high growth band in the area of mathematics you take a look at the median scores again if you're looking at pre pandemic median scores at 50% California's last year on average median score was at 35% Nationwide they were at 45% Carl bad was above the pre-pandemic uh median score at 51% so we outperform California and the nation as well as um you know pre-pandemic growth as well so um while we didn't hit the proficiency levels that we wanted to I think that this is a good indicator that we still grew and we grew at a level um far exceeding the state of California as well as the nation as it relates to math and this is a very big sample size we're talking about millions of students so um one of the areas

134that we do know that we want to hone in on this year is isn't in the the area math so we've created you know a math action plan so these are listing out some of the things that we're going to be doing uh we're reestablishing those salt meetings at the secondary level we're going to emphasize it at our grade level meetings especially at the elementary level with the focus on math we've added a tosa which we think will be a great addition to focus around um taking a look at our scope and sequence and working with our math leaders throughout the uh School District to offer Prof profal development and then as far as refining our mtss um strategies and targeted interventions we talked about these action steps I'm not going to go too much

135more into them other than just basically say we continue to work with our principles every year to identify site specific goals um both of those uh goals are in academics as well as social emotional learning um and we'll continue to do that with our principles this year that's part of the goal setting process every year and we'll dig deeply into the reports that we have and some of the data that we have uh in order to get after that and then we also talk about um other evidence-based interventions that will continue on for next year or this year excuse me in regards to um our continuous Improvement cycle one of the things that we don't need to decide tonight but um we do need to decide in October is to finalize our 2021 22 lcap

136goals and success indicators um we uh adopted a draft plan in the in the spring of last year staff's recommending two changes to those um success indicators the first is around the diversity equity and inclusion plan I know that we had mentioned before to bring that plan a draft of that plan back in January staff's recommending that that plan um be brought back in July there's several veral factors to this but primarily uh the biggest factor is is time and capacity we currently are not able we don't think to be able to bring you a quality product where we're reaching out to a number of different stakeholders gathering information um and have that ready for you in January we don't think it's possible we think a lot of our uh early planning this year as

137well as our director time um has been spent um specifically around covid and covid mitigation strategies as well as contact tracing which takes up a lot of time um so we are recommending that this plan be brought back in July rather than January the second one relates to the advanced class success indicator um we would ask that that be removed we think it's somewhat redundant based on the fact that we have a College and Career indicator that is already in existence on aate State dashboard which measures um many of the things that we already are trying to measure in regards to what is an advanced class so it's measuring um dual enrollment for Community College as an example it's measuring advanced placement it's also measuring um you know a number of different Advanced indicators so

138um those would be the recommendations as I mentioned before we don't need to have a uh a or to answer any questions in regards to these two recommendations but this doesn't need to be decided upon tonight and with that we're happy to answer any questions that staff or that trustees may have for staff thank you uh Dr n um director arus and director arbet for that presentation we appreciate it um trustees are there questions for staff um trustee Pearson hey Dr NY thank you and your your team and everybody uh wasn't here but is part of the team thank you for all the crunching of numbers and U you presenting some of the positive and some of the areas that need to improve um the current STAR testing that's going on right now when will

139what month will those be reported out to us in the community yeah we traditionally report that out we'll bring you a midyear report um where we'll um bring you that information parents will get report though on how their students did um probably by the end of October I would say beginning of November okay I have an unrelated question but I'll wait till thank you trust yep trusty Rings thank you um real quick on slide 10 uh where it says 83% UC CSU eligible um uh did those students have a c or better average as far as grades go or at least have a c in all classes or better yes okay excellent thank you uh I have a question but go ahead trustey Pearson oh thank you uh so Dr and I um I know

140we we feel you know very positive about some of the comparisons on some of the testing against the county against the nation or excuse me California and and the nation um and we've had these conversations before have you ever looked or have you looked recently on comparisons with similar districts I think we once were looking at Santa Monica Malibu which was comparative in terms of demographics and that and see how we stack up with them yeah we haven't since you know since we haven't given the S back the last few years um it's difficult to know you know not every district is a star Renaissance District so um we could certainly work with uh them to try to find match up uh other comparable districts to see how we relate to them uh it's not

141something that we've done since star has been suspended has excuse me since esac has been suspended but I would imagine as we get going again with espac this year it's something that we certainly will do thank you thank you I have a quick question on slide seven um for director arus thank you for providing this information on the AP test taken and pass rate my question for you director arus do we have comparative state and federal data on these metrics like how did this drop off compare um you know at the state level and Nationwide by chance yeah we are looking for that data um you know going to the AP website we have not found it yet so we will continue to uh look for that data and get that to you thank you

142and just to follow up has college board I know they're uh you know notoriously sort of closh handed on that on that information uh overall but did did they indicate that we should anticipate this kind of drop off based on the participation rates and the change in format that they provided online versus in person I have not seen anything released from them on that okay thank you um truste Rawlings thank you I have two questions on slide 25 so I'll try to ask you the easy one first um as far as the staff recommends changing the wording of the uh de and to a a delay timeline of July 202 22 um uh could that still be counted as a success indicator if it's after our um uh after our assessment cycle yeah we we

143think so um you know we count uh graduation data as well as a tog data some of those students finish up over the summer and therefore we're still counting them as part of that Year's data so we think the completion of the plan would satisfy in that year yes okay and then my second question related to this um would it be possible to have some components of the um strategic plan and um possible implementation from uh to be put into place between January and July or is does it have to be done all at once in a three-year strategic plan in order to implement um you know I think it could be possible I part of it is getting you know getting us together and and um working with what that timeline's going to look

144like but as we as we started to get into the early planning of this we realized that January's you know to reach out to stakeholders to have Community fors to gather the input that we're going to need to gather in order to Coal us around a plan on um and provide you know um multiple points of um communication with stakeholders January was just too much of a compressed timeline we we wanted to make sure that we're hearing from all stakeholders and we're putting a plan and a process together where everybody feels like they've been heard and to do that in you know short amount of months with all that's going on right now with covid didn't seem realistic so I to say that we can't bring you anything and I think we could um but

145I just didn't want to commit to having a three-year strategic plan laid out a draft plan laid out to you in January when I feel like that's setting us up to fail we don't think it's a realistic timeline thank you thank you trusty Williams thank you I have a followup on that of the Dei de and I plan if we move the date would this give staff enough time to implement in the fall of 2022 yes we'd think so if we had a a draft plan in place we still think we would have um goals for 2022 23 20 23 24 and 20 24 25 um and each of those would be um based on that three-year plan so we we think it would give us ample time to put those things in place yes

146thank you thank you truste Williamson I'm sorry I can't hear you the audio is compressed am I the only one hearing it weird like that no I am to I hear it as well I'm sorry trusty Williamson we still can't hear you okay truste Williams thank you um for um your request that staff recommends to remove the advanced class success indicator um is that this what you're talking about is slide two um the number two number one goal but number two line item yes sorry I can let me see if I can go there real fast want to make sure that I understand which one so unold one lined uh success indicator two correct it's the entire success indicator okay so then so then for the career in college readiness it only accounts for AP

147uh advanced placement classes I'm trying to see does it account for Middle School it just only accounts for high school it only accounts for high school um it does account for pathway participation um so that it's not just advanced placement and also uh Community College which is correct pretty much what we measure at the high school it's it's almost redundant at the middle school level you know I we can provide some more detail about this but I think we're um based on the courses that we have at the middle school level and I I'd want to hear director aras's input on this as well but I don't know how much more we could go back and look but I think we're right at that 50 percentile um and I don't know if we're going to

148get much higher than that um based on the courses that are available at the middle school level um so you know to keep that we can certainly keep it there we can take a deeper look at it but I think we're somewhat capped out at the Middle School director did you want to add anything from that no I agree with that just looking over the data and the fact that you know there are limited classes okay so we would REM be removing the middle school but you're saying right now at this point we're capped out so okay thank you okay so trusty Williamson are you uh back with us you're muted and we don't see you so okay I have um me see here actually I can you hear me now yes we can go

149ahead all right I'm uh if you go to go to slides 14 and because I lost my computer twice you may have already answered this um it states that uh Elementary School and Middle School data will be available once students complete the star the fall star assessment um my question is will the data for summer school students be looked at like as a group to compare with the students who didn't participate in summer school to look at the effectiveness of summer school yeah we're we're um what we thought we would do is take a look at the data of anybody that took Summer School uh both at the elementary school middle school level and potentially compare that data with where they were at the end of last year um and and see if we saw

150um growth as far as um you know grade level proficiency um and um you know part of that SGP growth as well the student growth percentile um we had not contemplated uh taking all other students and um comparing that to all other students but we could certainly do that as well um pull them out and take a look and and compare them to all other students that didn't participate in summer school to me that would be very helpful if you did I think that would give us uh some some good data sure we could we could do both of those things thank you it so just to make sure is that a request trustee Williamson do you want to um we can call for consensus I'm not sure how much time that will take and

151if there's support from the rest of the trustees Dr n how long would that take I I think we can pretty easily run a custom report that would isolate the students that took summer school versus the students that did not so I don't I don't think it would take much time at all okay so can I see by a show of thumbs could we stop the presentation my my my thumb is up okay my video stopped working um I can't see the rest of the trustees thumbs up okay so you have four thumbs up one thumb down and I just want to explain the reason why is because we're being told that staff doesn't have enough time to work on the de and and so I don't want any from my persp perspective I don't

152want to have any um additional that would take away from their work on that thank you um so you have consensus 4 to one Dr n trustee Williams so I have a request but I'm only requesting it if it's already um it's if it's already been looked at um it's Slide Five the AP um exam completions have you broken it down by classes or subjects and could we see if we get that report yes we can uh provide you that report and we have broken it down by class by subject by subjects and by that's correct correct okay so do I need to make a request or since it's already we can include that in a update to the board perfect thank you trusty Williamson yes I what was the reason that students gave for

153not finishing summer school do we have that information director Aris do you want to chime in on that I know you've been working with um principal Redfield on that one yeah um I can talk to her again I don't have that specific information again we did have students who took multiple courses so some of them thought they would be able to finish more than than perhaps they did um some who might have had just you know some delays in summer um but they knew that we would allow that option to continue we would pause where they're at we would be offering Apex sections um and that they would be allowed to take it there some kids were also burned out and and uh you know needed to take a pause and we wanted to to

154honor that to make sure that they got a break as well um but I can touch base with her and see if there was any additional reasons reasons that she heard from students okay thank you thank you any other questions for staff trustees seeing that there are no more questions for staff we just want to say thank you to Dr NY director Aras and director orbit for this presentation we appreciate the updated information trustees this brings us to item 8.3 uh is there I got a note we have any discussion oh thank you trusty Ring's discussion trusty discussion I trusty Rings thank you um I did want to express some concern about the um the de uh being um delayed and um I I my hope is is that and I don't know if I

155need to make a request or not but I would at least at a minimum I would want to have like a progress report by January and again I don't know if I need but I if if it came back in the form that it is now where it would be completely delayed till the um 2022 um I would not be voting in favor of it in October and I just want to make that really clear I mean I find I think that that's a very important aspect of our lccap and um we had lengthy discussions about it and I understand that um that staff is being tugged in multiple ways um but I also do think that um that it's a priority and it should be a priority and therefore um I would not be

156in favor of it unless we had maybe a modification of what staff is recommending like that there would be a progress report in January or something along those lines to at least um uh ensure that this uh Main Mains that uh this remains a priority and would um not fall off the plate and fall to the back of the tabs for instance trusty Jones yes if I may so uh in response to trustee Rawlings question about whether or not she you know needs to ask for consensus I would argue that you don't need to do that this evening because this would be a discussion action item that's brought to the board in October so um if if that makes sense that would be the appropriate time for us to finalize that discussion okay so we

157don't need consensus for the two recommendations for staff this is just staff bringing it forward to us for consideration For an upcoming agendized item on the on these particular success indicators and goals correct okay and actually I'm sorry oh sorry I just want to say as as part of the discussion that because we are in discussion um I would like to hear what my fellow board members think about that also as far as um actually potentially delaying this until July 2022 if that's possible any other discussion for me uh I I understand and and absolutely prioritize this what I would hate to rush is stakeholder input in the process um because then I don't think we'll capture as much uh feedback as we'd like to build the plan from stakeholders and if if staff is

158stretched to just hold those meetings I want to make sure we capture that feedback because I think a strong plan will be one that shows participation with you know Community stakeholders and members um to make sure the plan is built around that feedback so that that is my only caution that if we rush staff what I hear them saying is that holding the stakeholder feedback to build the plan is is daunting right now given the current um level of work it's not so much that the work is being pushed off so I respect that I know we're asking a lot with three different strategic plans on the on the hopper so if staff if I I think when we come back to this item it may be a recommendation that we look at those three

159items and say what can we put on the back burner or prioritize them for staff if that if that would help staff stay on on target um and so that's what I'll say about that I guess um on another topic staff asked are there other success indicators the trustees would like to modify or change for the 2021 22 school year and I apologize Dr NY I didn't pull the trustees are there any other success indicators based on this presentation that trustees wanted to change now would be the time to let staff know yeah and and trusty Jones if I may that that was included you know in case that there were things that staff needed time to work on between between now and and the next meeting thank you Dr Churchill uh truste Rawlings um

160since I have the opportunity here to do this I will formally say that one of the modifications I would like to see is that the um uh the the uh de and I um that we receive a progress report in January and that we received the completed plan uh the Strategic plan in July of 20202 thank you trusty Williams thank you I like the idea of having getting a progress report at least for that for January so I would support that and that's obviously you know what at that a snapshot of what we how what the process is right now of the DEA plan Dei plan um in January um and then I'm looking at sorry this is kind of a question for staff because I'm looking at the success indicator to remove for advanced

161classes the only thing I notice that's not included and correct me if I'm wrong not including the College and Career Readiness are honors classes is this correct that's correct okay so then okay it would remove honors classes and only include advanced placement and Community College classes because I see college credit courses in the ccnr correct okay so I would if if if rest of the board board is okay with that I'm okay with removing the advanced class success indicator knowing that we're going to lose honors classes um the results from that so I'm curious other what other trustees think thank you truste Williamson yeah I am not comfortable removing that I think that we were intentional about having some type of a success indicator specifically to um towards encouraging Advanced Learners and I believe that

162just having it on the basically on the back tab does not um provide the type of um of emphasis that we have traditionally had I'd be okay removing it if we put back the AP pass rate but I don't think that we were interested in doing that so I if anyway I I am not comfortable removing it but I know we'll have talk we can talk about it more in October thank you trusty Williams okay so another suggestion would be removing the middle school knowing we're back capped at the 51 at the 50% on that on that success indicator I'm fine with that and and I concur as well truste Pearson I'm not sure I'm convinced about the middle school going to the back tab um and I'll tell you why um I've seen some

163we've seen some numbers on math um in particular so I'm not sure I'm a little more convincing a little more of you know probably Dr n know you said we might have hit our ceiling I'm a little bit concerned about that comment as well uh to that so so um based on the the tpe the amount of classes we have available um you know I don't want to take a lot of time on this but uh you I think i' want to explore that a little more because those are all tied and that's how we really measure those middle school students there so I I'm not sure I'm feel feeling real comfortable with that move that movement there on that metric thank you trusty Pearson trusty Rawlings um I con with um trusty Pearson that

164um I do believe that um uh that there are things that we can change up there's our you know potentially additional classes we can offer there's additional supports we can offer in order to move that um those numbers in addition I do believe that um some of the some of the testing is going to be changed up I mean we're already hearing that colleges aren't going to require the SAT and that you know AP classes may be different and so um I would like to you know I mean we're going to have a further discussion but I would not be in favor of switching out the Middle School um for some of these other High School aspects when we're still unclear of I guess the weight of some of these tests and some of these

165um uh classes moving forward thank you any other comments for staff oh sorry okay uh trust trusty Williams thank you um the only reason I mentioned it since staff mentioned um sorry about the middle school is they're maxed out they're stating they can't do the de and plan so I'm trying to give by by by giving they'll you know the take give and take so I'm trying to be trying to accommodate so because I know they're maxed out with the with a mitigation learning loss there's other items that are on this the goals and success indicator this year more so than in previous years so this is where I'm giving so that we could get more information more on the de and plan thank you trustee Pearson you know I appreciate trusty Williams uh analysis

166of that I did not hear that from Dr NY it was a give and take piece as much as what I did here was that it had to do with you know I think we hit the ceiling um I think director arus said um you know I agree with Dr n about the classes and with truste Rawling comments I'm I'm in alignment with trusty Rawlings comments I think there's still some more discussion about you know what what else can we do uh with the resources we have and I I I I'd I'd prefer to do that if in fact this is a tradeoff I didn't hear that I'm sorry I just I didn't hear that and if it is Dr NY please bring me back to that one and I apologize if I didn't hear

167that from you thank you trusty Pearson any other questions for staff okay as this is a an information discussion item uh we want to again just say thank you to Dr n director arus and um director arbet thank you for the presentation um there has been a request Trustees for a 10-minute break it is 8:33 uh we will return an 8:43 tene Jones I heard a f minute break request oh five minute break 8:33 to 8:38 excellent thank you is that okay with everyone okay thank you thank you it is 8:38 p.m. returning from a break and uh trustees we are at item uh 8.3 approval of the 2021 2022 local control accountability plan this item is a discussion action item trustees and for this I'll turn turn it over to Dr n thank you

168president Jones trustees Dr Churchill every year we submit our completed local control accountability plan to San Diego County Office of Education they review the plan and then send that to California Department of uh California Department of Education uh each year we have some minor language changes this year we had some language changes uh that we've Incorporated uh the full the full plan is before you today and exhibit a nothing material um to report there was one um change in revenues or expenditures excuse me uh in the budget as it related to unduplicated students but we're still well over the threshold of the 4.7 million that we required to um earmark towards unduplicated students and we're at $5.2 million for this upcoming year so staff recommends approving the changes so we can send that to uh

169the county for final adoption thank you Dr NY uh any questions for staff trustees okay and seeing and trustee Williamson I know you're having some technical difficulty are we able to see your hand or I I think that I can raise my hand okay good okay seeing that there are no questions for staff um may I have a motion to approve the 22122 local control accountability plan or lcap which is found in exhibit a so moved Williamson thank you a second please Pearson second thank you um so that was motion by truste Williamson seconded by truste Pearson board discussion seeing that there's no discussion I would just say thank you sorry trusty Rawlings um just as we've gone through this process I have not been supportive of some of the pieces within the ELC cap

170this year so um I will not be um voting in favor again I just wanted to clarify that thank thank you and I just wanted to say thank you to staff for working through this process and please extend our thank you to the San Diego County Office fed for their work seeing that there's no more uh trusty rling your hand is up okay seeing that there's no more discussion Miss Garcia will you please call for a vote truste Williams yes trusty Rawlings no trusty Pearson yes yes truste Williamson yes trusty Jones yes thank you everyone thank you Dr n uh now we are at item 8.4 the approval of the three-year technology plan 2021 2022 uh through 2024 trustees this is a discussion action item and for this I'll turn it again over to Dr

171nine thank you president Jones as the board recalls we brought a draft plan plan to the trustees on the July uh board meeting we've Incorporated the suggestions from the trustees during that July board meeting into this current draft or into this current draft and we're H happy to answer questions I know director Hartman has joined us on the call as well so if you have uh any of the questions related to the plan we're happy to answer those now trustees any questions for staff uh trustee Pearson uh this is for director Hartman and I probably ask this all the time but it's only because I I'm kind of in the space and it has to do with bandwidth and um our Reliance on our projections on how many devices at our schools and with some

172of the um Remodeling and construction and some everything that's being done uh it appears that more bandwidth is going to be needed and so I just want to ask the question with all that are we pretty liberal in our uh assessment of how much bandwidth we need not conservative but liberal in our assessment on how much bandwidth we're going to need to accommodate and we're not going to be slowing up we're not going to have you know some crashes and you know kids getting somewhat familiar at the younger grades downloading you know big files and all that so I'm just asking Dr or director Hartman yes I appreciate uh the question trusty Pearson um bandwidth monitoring is something that we do on a regular basis um the most recent assessment we made was last week

173in partnership with our um our network provider AT&T we met our new account representative and reviewed some of the numbers that we are seeing from some of our campuses um and as a result of that meeting we actually last week just upped the bandwidth um from 500 Megs uh per second at both of our high schools uh to a full 1,000 Megs or one gig per second um based upon some of the usage that we were seeing and uh this is something that we'll continue to do especially in light of um our our return back to campus and are seeing you know many more staff members and many more students uh using the netork work than we've seen in you know the previous 18 to 24 months um so that's very useful information for us

174to have and in addition to the adjustments uh needed at the high schools we notice that there are also adjustments required at both of our shared campuses Aviara Oaks and Cala Hills um by virtue of the fact that two separate schools are piggybacking onto the same um local area network um that would explain their High usage numbers now unfortunately uh when we upgraded to the most recent Network um configuration a few years ago we had the foresight to purchase more capable equipment and place that at the high school which is why last week it was only a matter of pressing a few buttons and paying a bit more each month in order to upgrade uh the speeds and bandwidth capability at our high schools uh but we did not have the same foresight for our

175other campuses and as a result it will be some weeks even months um for us to upgrade aiar Oaks and Cala Hills bandwidth because we have to negotiate uh AT&T service providers to come out and actually install additional physical equipment that is capable of the higher speeds that we're Desiring um so we're in negotiations to provide that at this time um and hope to be able to provide that additional bandwidth uh in the coming weeks uh so that that's kind of where we stand and our our numbers that we're noticing at all of our other campuses um appear to be right on track so it's only those two and um and and we're aware of the problem and working to address it thank you director Harman thank you trusty Williams thank you I have two

176questions but I'll just go with one first um in goal five the we don't have the presentation that right or the it's it's can we modify the language because it states um a checkpoint that at the start of the 2021 22 school year students in grade three and N will will be issued one to one take-home devices could we state it to say take-home new devices because it does it seems like you're just students only in grades nine and only in grades three get get devices yes we can clarify that it's a good point we will make that change before uh the final document goes out thank you and I have one more question but I can wait go ahead okay um and I I know I asked the question if we approve the tech

177plan are we also approving the two new support positions which we are not will if you do need POS those positions because I know now that we're going to be one to one and more students are using it the need might be there are you going to come back to the board yeah what we figured we'd do is weave that into the um budget discussions and so as we're talking about budgets for next year we'll work with uh assistant superintendent um uh and cabinet to identify whether or not you know that's part of the larger budget discussion so we'll we'll work on that okay thank you bring it back to you in the spring okay thank you trusty Rawlings thank you um I also have two I'm going to ask the one when we're talking

178about onetoone devices are we also um considering or looking at uh how many students are actually bringing in their own computer computers no we're not considering that um in general we discourage students from bringing their own devices to school um there's a lot of reasons for that uh most of them just having to do with consistency and reliability um for example it would be difficult for a teacher to negotiate a lesson if we had students you know bringing a core i7 16 gigs of RAM PC laptop and their partner has an iPad to for example um so we strive for consistency of experience both for the sake of our students as well as for our teachers um and then you know one of my concerns is the director of technology is just Internet Security um

179it's difficult to to police you know personal devices and and what sorts of programs staff or or students may have installed on them knowingly or unknowingly um that could disrupt our Network or or compromise um the Integrity of our you know information technology systems um which is to say you know we we we allow it we obviously maintain a a guest Network um but it is not our preference and I would discourage um students from bringing personal devices for those many reasons thank you uh truste Rawlings I had a second um question and it kind of has to do with that as well so with the upgrade I mean or with the onetoone devices will they be upgraded Andor does the WiFi um would that be an expansion uh my understanding is is there's students

180that are wanting to bring their personal devices because of lagginess and or the ability to and we' had this conversation before of being able to utilize their equipment outside so um can you point me in the direction where it um IT addresses those two concerns within the report yeah um I think there's a section on infrastructure that explains that we are in the process of upgrading both our Wi-Fi network and our wired Network as part of the um measure H Bond construction So to that point we've upgraded the wi-fi at several schools um but not all and we've also upgraded the backbone Wi-Fi at our new construction sites and look forward to continuing that roll out as the measure HH work progresses with regards to the expansion of the Wi-Fi um director iwamoto and myself

181are in the process of uh creating an request for proposals uh for outdoor Wi-Fi installation um I shared some of the heat maps that were created from uh our our work on that project uh at the last four board meeting in July or not the last board meeting but at the board meeting in July um and we have all of those now ready uh to facilitate our creation of the RFP we looking to release that uh for bids uh very soon here um and I'm not sure at this point what the timeline for that would be but we're hoping to move very quickly on it especially given that many of the locations um that we will be installing already have cabling pulled as part of um this body's foresight and paying for the extra cable

182to be run during the security camera installation last year so we're hopeful that we can be Speedy in that roll out um and between the two and the increased uh standards for our student Chromebooks which are included in the 2021 to 2024 educational technology plan uh we believe that the new devices that we're spending a bit more money on for our students will help to address some of the performance concerns that they've expressed in the past thank you any other questions for staff trustees okay seeing that there are no questions for staff may I have a motion to approve the three-year technology plan for years 2021 through 2024 don't mood Rawlings second Williams I'm sorry I didn't hear the first was it was Rings okay um let's see motion by truste Rawlings seconded by truste

183Williams board discussion and I'll just kick it off by saying that I was pleased to see the inclusion of implementing one uh grading communication system for parents I I'm looking forward to that happening anyone else concur with I'm sorry sorry trusty Williams I was gonna say the same thing truste Rawlings I guess I'm going to provide a third on that one totally agree with that and um and I do appreciate um uh the the plan itself and um I do want to give um acknowledg acknowledgement to Dr Churchill um five years ago when we um when we hired him we asked him to make this a priority and um he's continue to do so um and so um and making sure that we have an actual strategic plan to deal with technology rather than just

184kind of randomly grabbing at technology as we go so um I do give kudos to Dr Churchill on that as well thank you and I would just add to director Hartman uh we appreciate your leadership on pulling uh the teams together I know you're working with stakeholders on this and so to bring us where we where we are versus where we were is is really uh tremendous so thank you both for that work and your teams please extend our our gratitude if there are no further comments um trustees uh actually miss Garcia May will you please call for a vote truste Williams yes truste Rawlings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you next we come to item 8.5 uh approval of coordinator student health services a new position trustees this

185is a discussion action item and for this I'll turn it over to Mr Grove thank you currently student health services are provided by a single credential District nurse under the supervision of the director of student services and by classified health technicians at each School site we've identified a need for a management level employee to oversee all matters related to student health services including facil facilitation and monitoring of the 504 accommodation process planning and implementation of a comprehensive student mental health program the supervision and evaluation of related staff and serving as a member of the district's covid Response Team along with the directors of instructions student services and Personnel Services um contact tracing as you have heard from us on a number of occasions has become an arduous task that is uh really overwhelming our staff

186capacity and this position would be intimate involved in that and while covid-19 has certainly accelerated the urgency of this position it's not the precipitating cause for recommending the position prior to my arrival in the district about nine and a half years ago um actually just prior to that during the last recession the last big downturn prior to that the district had at least four certificated credential nurses in the district which we have over time um through budget cuts and attrition allowed to dwindle to a single individual who provides all the student related Health Services we want uh this management position we be able to evaluate and and supervise licensed staff as well as um non-licensed staff participate in the development of a comprehensive plan for the implementation of student health services which likely will include

187additional licensed nursing staff um currently the the district nurse position which has been in effect since 1992 is also in need of revision as I and as I indicated to the trustees previously once this position becomes approved and we move forward we would be bringing that to we would be revising that position as well happy to answer any questions you may have oh one last thing I'm sorry with respect to the the minimum qualifications for this position obviously a a valid school nurse credential would be a requirement as well as a registered nice nurse registered nurse licensure but we would also like this position to have an administrative credential that would allow them to evaluate certificated staff such as credential nursing under their supervision with that I'll happy to entertain any questions thank you Mr

188Grove trustee Pearson so there's a few questions I have for you Mr Grove regarding an an additional administrative position um if Co 19 goes away um everything to do with covid-19 goes away and I I understand your comments were that this is not what precipitated the the position but let's just say covid-19 goes away um what how what percent how you do you see what percentage of that position currently has to do with anything to do with covid-19 it's difficult to say you know when you consider current positions in the district who have shifted their their attention to covid you know in those cases their attention will shift back to other areas as they have previously this particular position obviously would be very covid heavy on the front uh side of the position but over

189the long term there's enough work to go around as I said we had four licensed nurses in the district previously at least at least four four that I was able to determine I'd heard the number five but I was unable to verify that so there's plenty of work to go around um 504 management is uh you know 504 accommodation plans are plans which assist students with medical conditions underlying conditions access the curriculum more effectively and they there there is a process that is undertaken they can be problematic for the district when they're not done correctly they're not monitored uh this position would be the central uh oversight for the 504 accommodation process and provide assistance and facilitation services to the schools so again I I think that there's plenty of work for this position outside

190of a CO environment at the beginning certainly Co would be a you know a significant part of their work and just to add on the 504 has have those cases been increasing in our district they have along with all manner of disabilities 504 have have come up and we've had some some issues with some of them so uh this position is is critically necessary for that I'll hold off I have one but I'll wait I'll wait till few other folks pres thank you trusty rling thank you um I just wanted to uh find out um what other districts have this position um in our surrounding area U that's an excellent question which I can't answer at this point in time I these positions existed in former districts that I worked in and districts in Los

191Angeles County that's where I brought the concept from and relied upon their um their draft job descriptions to assist us in the development I didn't do a survey of San Diego County districts to determine who had them or not based on your research would could you just give us a few districts that have this position within San Diego County no I can't no no it just Palmdale okay thank you Steve Pearson I I think you wrote up about uh this position would manage I think manage or administer a comprehensive mental health program uh correct when would we get a presentation on what that comprehensive mental health program would look like after the position is filled and they have an opportunity toh work with the instruction team who currently is working in that Arena uh to

192develop it I it would be a high priority something that we would uh you know put at the top of their their list of tasks upon uh joining the district you know we we we have shared in this group many times uh trustees have expressed concerns about student mental health uh over the years obviously Co again has exacerbated that and raised a lot of folks level of awareness but it's an ongoing need that has increased over time and uh you know rather than attacking at peac meal we really need a comprehensive plan for addressing student mental health and that would be a significant uh portion of this person's responsibility thank you so I have a quick question for you Mr Grove um when you layered in the administration credential uh does that mean and I'm

193I'm not as familiar with the 504 meeting process as the IEP process and I know one is probably more intensive than the other or maybe not you could correct me if I'm wrong but will this person serve in those meetings in Li of Administrators or could they if that was a part of their role not necessarily again I think you know we'd want to allow this person to uh help construct what the job looks like upon their arrival once they have assessed what our needs are and they make recommendations to us about where the most significant places that they could assist would be um at the very least there needs to be a central repository for 504s to ensure compliance and that would be the primary task of this individual but certainly they would participate

194in the 504 plans whether they would replace the administrator I'm not I'm not sure that we you know contemplated that specifically the other thing that this uh individual would do with an administrative credential is is have the capacity to evaluate certificated staff such as credential nurses okay trusty Pearson a little out of the box and I think I already know the answer but I need to ask it anyway um any thought instead of hiring an administrator for some of this role would be an outside consultant well you know generally speaking um there's an assumption that's often made that hiring outside consultant saves money but frequently that that doesn't turn out to be the case um honestly we had not contemplated that I think that we what we would want as a dedicated staff person you

195know the Co contact tracing is a good example right now uh Health techs at school sites assist in that process but frequently those calls or emails come in in the evening and over the weekend and that's not work that a bargain unit member or possibly an outside consultant would be available to do at the drop of a hat whereas if it was our our management employee that could be you know a piece of their responsib ability um again not to put this back on Co but that's an example of you know something that would be immediately necessary that we would have a staff member able to to to hit on um so no we hadn't really contemplated this being a being a contracted position any other questions for staff um I have one last question

196I guess uh I think I would be more comfortable if we had an idea of the the the scope so rather than have someone come in and Define it for us that we as a staff determine those uh job priorities and goals um as you know as the person that we hire on they know what they're coming in for so that the person we hire doesn't have a surprise you know I understand the needs are great in 504 I I get that particularly in special ed we are underst staffed I I know um and so I guess how would you respond to that Dr I mean uh Mr Grove no it's a fair question and and I don't mean to suggest that this person will Design their job I shared with you a draft job

197description recently um that is a laundry list of things that this person could be involved in um but just as you know the personel Department evolves over time when I arrived here I I you know I looked I what are things that have been going well what are some things we can improve on where are our our critical urgent needs and and develop to plan and and move forward I we would expect that this person would participate in prioritization of that I mean certainly that draft job description as an example is is uh is is pretty pretty full of tasks so I don't think that it's a question of them designing the job it's a question of them assisting us and identifying what the Urgent priorities are what the long-term planning needs are and obviously

198Co and mental health are going to be top of that list okay thank you for clarifying that I I did read the job description and saw that the the the plate was pretty full and so when you said that it was confusing so I apologize uh truste Pearson so I read the job description too and Mr Grove what would your expectation what what you know how are we going to measure the performance of this employee what are we going to see some differences are we going to you know what are some of the things we're going to see differently in our district with this position and that's what I had I saw the task saw the workload and I was going okay so how am I going to measure the U the performance of this

199position you know what's going to change you know what's going to improve using our continuous Improvement cycle um H how would you see Mr Grove well well right off we would have you know the development of the comprehensive mental health plan so the creation of that document and and implementation of it would be one metric we would look at another would be 504 compliance you know we we don't want to have 504 plans that that trip us up now this position would report to the director of student services Tim Evanson who would direct the work and in consultation with Tim and the district nurse um you know this would not replace the current District nurse and I haven't spoken much about her because she may in fact be a you know an applicant for this

200position so um but you know all things being equal she'll have undoubtedly some some input uh in when this person arrives if it's not her um and help us you know design what what the day-to-day function looks like on the outset okay thank you any other questions for staff trustees okay seeing that there's no questions for staff may I have a motion to approve the position of coordinator student health services go moved Williams thank you and a second second Rings thank you the motion by trusty Williams seconded by truste Rawlings uh board discussion trustee Williamson thank you um this position makes sense so I will be supporting it assuming my assumption all along was that the that this position would be managing the 504 meetings and that there would not be a need for an

201administ an additional administrator um in the meetings and so I would strongly if if that's at all possible that would be uh I I believe an assumption that should be part of the job because we dear we have heard heard how often our administrators are um being pulled in so many different directions and that this person especially with with the specific 504 if if that would be feasible that would be um I would be very interested in that thank you trusty rings I will also be supporting um this position I do believe that um I have seen it work in other districts and that it is a um uh it it actually represents a commitment to um uh Improvement in mental uh in mental health for students oftentimes we say we have this commitment but

202then we really have a difficult time of actually implementing programs so we end up doing surveys or we end up you know it's kind of um hit or miss so I do believe um having somebody in charge and actually developing um similar to um what we just talked about with the technology plan when you have an expert involved and you have them um setting things up and and putting putting things in motion um that's the way I think we actually get things done and we have measurable uh results so I will be um uh supporting this thank you any other discussion seeing that there's none may I have a mo uh I'm sorry uh Miss Garcia will you please call for a vote trustee Williams yes truste Rawlings yes trusty Pearson yes trusty Williamson yes

203trusty Jones yes thank you Mr Grove thank you very much this brings us to item 8.6 resolution number 11- 2122 sufficiency of textbooks and instructional instructional material for uh 2021 2022 trustees this is a discussion action item and for this I'll turn it over to Dr NY thank you president Jones uh I would only say that this is an annual item that we bring each year I know we did have a speaker that uh spoke earlier uh in the evening specific to positive prevention plus just for clarity purposes um we do not use that curriculum at the elementary level it's it's line item as you look at the exhibit there is no um positive prevention plus under Elementary um And in regards to the middle school and the high school units we select units that

204were required to teach by law and spelled out through CDE as far as which standards as we've always done in the past we uh give parents ample time and there's an opt out uh for any parents that want to opt out of that curriculum they have that opportunity uh and principal send out those opt out letters prior to uh any uh materials being implemented so with that I'm happy to answer any other the questions that you have in regards to the curriculum and uh thank you for your time thank you for that clarification Dr n trustees any questions for staff seeing that there are no questions for staff may I have a motion to approve resolution number 11- 2122 declaring that each student has been provided sufficient textbooks and instructional materials aligned with the content

205standards and curriculum Frameworks in exhibit B so moved Williamson thank youings thank you that's a motion by trusty Williamson seconded by trusty Rollings uh board discussion seeing that there's no discussion Miss Garcia will you please call for a vote trusty Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you Dr NY this brings us to item 8.7 resolution number 08- 2122 teachers teaching outside credential authorization per Ed code d10 um through Ed code 44 uh two I'm sorry Ed code 44263 this is a discussion action item trustees and for this I'll turn turn it over to U Mr Grow thank you this is an annual resolution which comes before you each year permitting staff to work outside their credential area you'll see we we're very judicious in our use

206of this um most of these are people who are teaching for example marching band permitting them to give PE credit for for that as an example um our athletic directors who to our athletic directors for uh 80% of their contracts but maybe handle independent study PE for the other 20% permitting them to do such uh there's only nine staff on the the sheet and uh there is no change I take that back there's one change it was a change in the athletic director at Carl's bat High other than that it is same list you saw last year thank you Mr Grove uh questions for staff trustees seeing that there are no questions for staff may I have a motion to approve resolution number 08- 2122 teachers teaching outside credential authorization per Ed code 44253 do10

207through e Ed code 44263 Pearson so moved thank you second second Rollings thank you uh motion by truste Pearson seconded by truste Rawlings uh board discussion seeing that there's no board discussion Miss Garcia will you please call for a vote truste Williams yes truste Rawlings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you Miss Garcia this brings us to item uh 88 resolution number 09-222 week of the school administrator trustees this is a discussion action item um for this I will uh turn it over to Mr Grove thank you it's time for our annual resolution recognizing the work and service of our administrative staff recall that we we celebrate certificated and classified staff in May um and we used to celebrate administrative staff in may as well um but it was awkward

208in districts where they were issuing layoff notices to be celebrating administrators concurrent with that unfortunate timing so State of California moved the week of the administrator to the fall which was believed to be more appropriate so this week the week is October 10th through 16th and happy to answer any questions thank you uh we do have one speaker do we do questions yeah questions and then the speaker and then thank you uh any questions for staff on this item okay trustees we have one one public speaker on this item as noted in our agenda for each agenda item no individual presentation shall be for more than 3 minutes and the total time for this purpose shall not exceed 20 minutes ordinarily board members will not respond to presentations and no action may be taken however

209the board may give direction to staff following a presentation speakers are asked to State their name and indicate whether or not they live within the boundaries of our school district our um speaker tonight is JB Scranton you will have three minutes doc Dr Churchill has posted the timer and uh the last three digits are 2355 hello and we're on the record yes thank you madam chair may it please the board again JB Scranton San Diego's number one sub and foster parent and I do not reside in the district Madam chair resolution 92122 is a frivolous waste of time as are most resolutions of this type this board should vote against this resolution because it does nothing to improve educational outcomes moreover administrators are the least deserving of recognition of those in the org chart especially

210when you consider the work of janitors psychologists teachers special education AIDS just to name a few this is a duplicative resolution in as much as administrators already get recognition in the form of their salaries especially when you consider that they don't have to carry a grade book they're given extraordinary powers and privileges with their jobs administrators don't need one day of appreciation let alone a full week of it please note that carlbad has great schools not because of school administrators but not withstanding School administrators for these reasons please swiftly bring a vote against this waste of time and move on to more worthwhile uses of time and as a postcript uh I must mention that Ben should not be controlling the public comment much of the comments uh during tonight are critical of him and

211this creates an ethical conflict of interest to Take Ben's finger off the button and with that good evening thank you uh trustees may I have a motion to approve resolution number 09-222 designating October 10th through 16th 2021 as week of the school administrator as published an exhibit a so moved Rawlings first and second thank you a motion by truste Rawlings and seconded by truste Pearson uh board discussion seeing that there's no discussion misss Garcia will you please call for a vote trusty Williams yes trusty Rings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you Mr Grove this brings us to item 8.9 revision of board policies first reading the trustees this it Jones oh yes we normally uh read aloud the um the resolutions for uh employee groups uh okay so following

212the vote let me pull it up here okay does everyone have the resolution pulled up yes okay uh I'll begin resol or I guess Dr Church shall you begin uh sure thing so we're going to go straight to the whereas whereas approximately 15,000 certificated and classified school administrators work in California's public schools and whereas nearly 60% of these administrators are principals and vice principles providing direct support for the educational programs at school sites and whereas research has determined that one of the main attributes of effective schools is the competent leadership of principles and whereas other certificated and classified administrators provide leadership and support for the educational program by developing and implementing the curriculum selecting textbooks and instructional materials recruiting training and evaluating classified and certificated staff managing the budget and monitoring cost controls implementing Schoolboard

213policies and complying with federal state and local regulations and laws planning and maintaining school facilities and providing Transportation nutrition and social service programs to pupils and their families and whereas research shows that effective District level Administration improves teacher effective Effectiveness and whereas research shows that Public School Administration in California has become increasingly efficient and effective with fewer administrators managing more schools with more pupils than in the past and whereas a school's administrative team includes confidential employees who perform and assist in the performance of many critical functions and whereas School administrators and confidential employees ensure that effective and Innovative classroom instruction is promoted in every area of California and now there be it resolved that the week of October 10th through October 16 2021 be proclaimed the week of the school administrator in honor of the

214many outstanding contributions and services provided by the administrative teams in California's public school districts and be it further resolved that the administrators of California public schools be commended for their support of and contributions to Quality education in the state thank you everyone okay uh this moves us to item 8.9 revision of board policies first reading uh trustees this is a discussion action item and for this I'll turn it over to Dr Churchill thank you trustees we're continuing to bring you board policies as recommended by the California school boards Association uh to bring our policies in alignment with uh either current statute or best practices as described by the csba so you'll see I believe 10 here for a first reading it's up to you whether or not you would like to approve them as a

215first reading and bring them back for a second reading or wave that second reading staff is here to answer any questions you may have thank you any questions for staff trustee Williams thank you I have a concern with policy 51422 the safe routes to school program um it states a program but we don't NE we don't have I guess a definition of what the what a program is so I don't know what's required by Ed code or can we modify what the term program is yeah there's no Ed code requirement it's it's a catchall phrase sort of an umbrella phrase for work that schools and um other area Partners often engage in much of the work around the state and in other states uh for safe routes to school um involve Partnerships between cities uh

216and school districts for example to reduce traffic impact around schools um uh there's not a specific program um and I agree that the the terminology is is a little bit confusing so we're certainly happy to uh uh clarify that and bring it back as a second reading so I have a followup to that trusty Rawlings is your question on that item so I've actually been uh in in the discussions for the valley um work that was done across their street that was uh as I understand it part of the safe roots to school and then the work that's being done at BV to raise um the pathway that's a part of safe roots to school and there's been other is that what it indicates by program Dr Churchill or is there something in addition no

217I think that's it you know we we also were involved a couple of years ago so pre pandemic uh with the city they had gotten the Grant and I don't remember which state agency offered the grant um but they were working with a consulting firm that had done traffic studies around each of the campuses in U carlbad we provided uh a generic address data on students so that they could determine the the density of students living within a mile and a half radius of schools and they were working on uh developing some uh using that data to develop some plans to present to us about ways to mitigate some of the traffic problems uh I I don't think that that plan continued once the pandemic hit but it's it's on our um to-do list the

218next time we have a city schools meeting to to ask ask them uh you know where they are on that uh and and um you know what the next steps might be so so all of those items fall under the umbrella of safe routes to school thank you truste Rawlings um this is just a general question um as we've had these uh board policies come up from csba does staff review them and then uh kind of customize them for Carl's Bad to reflect what is actually happening or what we do in our district we certainly review each one um we're trying to stick with the language uh that csba is recommending as much as possible um but certainly we um do make changes from time to time um as it relates to our district and

219anything specific to our district thank you Williamson thank you mine is I have several items but I'll just start with my general question to staff uh would it be possible when you present these to us so right now you're basically marking out everything that is existing and then putting a whole new um verbage and sometimes there's only a difference of one or two words between the two versions but you we have to go through line by line by line to see what the changes are when when these are presented to us would there be a way that you would simply strike through for the the CH if it's a minor change just strike through for the minor changes a and so that we don't have to go line by line by line so so we

220certainly could do that this is something that I think falls under a category of something that we we'd love for there to be consensus from the board on um uh primarily because it's a function of time um I don't disagree trusty Williamson that that sometimes it is hard to parse through and pick out what what changed and and I think we we can do as you're describing go in with a more fine tooth comb and show you exactly what the changes are it would just take a little more time on on staff's end which we're willing to do if if that in fact is the desire of the poort if if it's something if there are a lot of changes then this way is fine but if it's just a couple of minor changes we

221won't know that unless we go line by line and so I'm afraid that because it's so massive the way it is right now there could be some significant changes that are overlooked because trusty Jones process check we're not in discussion at this moment we're doing we're doing questions still thank you I guess trusty Williamson has your question been answered I guess I was trying to clarify my question to to see if when when Dr Churchill was talking about the the taking more time I I guess I just wanted to clarify it's not on every board policy but but your answer would be the same well I I understand what what you're what you're describing and yes there are times when the changes would be minor and it may not be as time consuming that's thank

222you uh truste D Williamson oops sorry I okay are there any more questions for staff okay seeing that there's no questions for staff I guess we're going to let me read the motion here um may I have a motion to approve the board policies 5126 5141 1.4 51 41.22 5141 31 uh 51422 514 5.9 5145 do12 6111 and 6158 as presented approved as a first reading and wave the second reading of so inclined trusty Williamson I was thinking in this case we might want to do one board policy at a time rather than the entire um Bunch because I I have some changes I want to make in my assuming there might be other people at it could be faster to do one at a time okay is there consensus from trustees to take these

223one at a time okay so may I have a motion to approve the board policy 51131 as presented uh and approve as a first reading and wave a second if so inclined I just wanted to clarify um I thought the first one was 51 41.22 uh on the on the exhibit apologize online it's 51131 May I have a motion so I I'll I'll give the okay okay I was GNA say second okay so that's um motion by truste Jones seconded by truste Rawlings board discussion and the motion includes a that we would wave the second correct that's correct so on this item seeing that there's no discussion Miss Garcia will you please call a vote truste Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you trustees may I

224have a motion to approve the board policies uh William and I didn't get the part about as presented and approved the first reading away of the second reading of so cin so I just want to make sure that's in the record so so so moved thank you trusty Williamson may I have a second second second Rawlings thank you so that's a motion by truste Williamson seconded by trust Rawlings Miss Garcia we please take a vote was there any discussion yes discussion board [Music] discussion seeing that there's none Miss Garcia we please take a vote trusty Williams yes trusty rolling Rawlings I'm sorry yes truste Pearson yes trusty Williamson yes trusty Jones yes thank you I was just arranging my screen so that I could see what uh the names of them are so may I

225have a motion to approve the board policy um 5126 as presented and approve as a first reading and wave the second reading if so inclined and this is awards for achievement so Mo Williamson may I have a second so move pearon um second thank you so motion by truste Williamson seconded by trustee Pearson board discussion seeing that there's none Miss Garcia we please call for a vote trusty Williams yes trusty Rawlings yes trusty Pearson yes trustee Williamson yes trusty Jones yes thank you uh may I have a motion to approve board policy 5141 do4 uh as presented approve as a as a first reading and wave as the second reading if so inclined and this one is Child Abuse Prevention and Reporting so move Pearson thank you and a second second Rawlings thank you so

226that is a motion by truste Pearson seconded by truste Rawlings uh board discussion thank you seeing that there is none Miss Garcia we please take a vote truste Williams yes trustee Rawlings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you may I have a motion to approve board policy 5141 d22 infectious diseases as presented approve as a first reading and wave the second reading if so inclined so I'll make a motion is there a second I will make a second for purposes of discussion thank you so 51 41.22 um board discussion trusty Williamson yes thank you uh if you want to look at the policy in the fourth paragraph there is this paragraph is new language and it reads in part if the local Health officer notifies the District of an outbreak

227of a communicable disease or the imminent and proximate threat of a communicable disease outbreak or epidemic that threatens Public's Health the district shall take any action that the health officer deems necessary to control the spread of the disease it then cites uh the help and safety code 75.5 and I read that in the code it says that the local Health officer May issue orders to other governmental entities to take any action that the health officer deems necessary to control the spread of disease but I don't see that it says that we must Implement every order without question so to give us flexibility to consider other possible mitigating action I recommend that we change the phrase the district shall take any action to the district shall heed the action the health officer deems necessary I believe

228that it provides um it implies that the default is that we shall um follow the the action but that it I believe it gives us a little bit of flexibility that I believe would be helpful to us so I had a question for you trusty Rawlings on the I mean sorry trusty Williamson um would this require that we have public health expertise on infectious disease in order to to create that flexibility and two would we be uh following I guess the letter of the government code that it that it uh captures obviously staff could um check it out to see if that would be a problem for us legally my understanding is that we if if there's a mandate we don't you know it's a mandate this is but but I believe that the health

229and safety code is saying that the health officer can issue all sorts of um can issue order let's see um that that they can they can issue orders anything any action there I'm just saying there could be a time when we could question what that action is that we could question it we could maybe try to send a letter saying asking for clarification and I I just think that this gives us some flexibility that we have seen not necessarily everything that maybe the public health officer issues that has relates to every part of San Diego County necessarily applies to us so I I think it gives us some flexibility obviously we have we are subject to um following the mandates as we have as we have learned thank you uh trusty Pearson Dr Churchill I'm

230trying to wrap my hands around what circumstances trusty Williamson is referencing do you see anything that we would want to question uh any direction from the county public health or the California Department Public Health and that we would have any flexibility on that no matter what our language says well I mean I I I think regardless of what our language says if the public health officies issue a mandate or a public health order um then there's other government code that that would be applicable um I can well I cannot provide a specific example um I I I think um what the the heart of truste Williamson's request is is that um in those cases where local flexibility may be allowed um my my my guess and you know correct me if I'm wrong trusty Williamson

231but the attempt here is to um provide us that flexibility so so I don't have an example of when that that might come into play but but I understand that to be the intent custy Rawlings um I would not be in favor of um that language and um just because I would not want to see it um interpreted and you know if we take ourselves out of this current circumstance but let's say we're just talking about lice or something um that would be um you know that oh it's not a bad outbreak so I just think it adds way too much discretionary aspects at the school sites when and when we're talking about a lack of expertise um I would not want to um see that happen so I would I would be voting no

232on that type of a change thank you trusty Pearson so after Dr trel's um analysis if you will of trusty Williamson's um proposition I I I think I would support it only because it gives us still more local control and and you know I'm a proponent of local control so I do like that part of the amended or the suggested language change so I will be supporting that thank you any other comments trustees so I would just add that uh there is a piece of the um that makes me um the fact that there is s uh health and safety code written in this manner I I I assume and I can assume actually I I would like to know if there's more to this than uh we have and if we haven't consulted legal

233on something related to a public health matter I don't want to be surprised by writing something that we run up against um in a legal matter and and that's not just taking into account What's happen happening currently but I think that there's an element to it that would require Public Health discretion that you know even anybody on this board I don't know of you know holding a public health credential to make that decision uh beyond the you know the Department of Health in San Diego County um their advisement on how to deal with communicable diseases um or an outbreak of so I'm struggling with trying to find um I I guess what I'm trying to say is I don't want to run a follow the law I think when I look at examples of when

234um boards have tried to push up against that uh they've been told by their legal team right away that uh they would suffer XYZ consequence and so I I'd want to be reassured of those consequences First Trust Williams could we ask staff to bring what Elisa's oh sorry what trusty Williamson is proposing to get at least legal perspective or legal legal ad advice on that and bring back yeah we certainly could I'm sorry to interrupt you yeah in terms of process um you know you've got a motion in a second on the floor uh of approving the uh policy as written and waving the second reading so um we'd need either either to modify the the motion on the floor um or or simply take a vote on it as it is and if it

235doesn't pass then then we would um you know potentially look at an update at a future time trusty Rings Dr Churchill um say stated what I was gonna say thank you trusty Pearson so if we wanted to make a friendly Amendment that included a review by legal uh we could do that but if I made the uh the amendment we need a second to the amendment and vote on the amendment and then vote on the motion yes we uh have a motion on the floor and so if that um doesn't pass then then that would be the case yes we would have a we we could have room for a second an amended motion who made the motion Miss Garcia I think I did and you did yes motion was by Miss Jones and second

236by Miss Williamson right okay so I guess on this item uh we actually had it as approve as a first reading and wave the second reading okay if so inclined so I will be I will be voting no on that so we can hopefully have a further discussion next okay okay trustees uh trusty Williams your hand is still up oh I was going to vote no as well okay thank you so um let's see with the second and so I guess Miss Garcia will you read the motion as it's written just so that all trustees are clear yes motion to um approve board policies 51131 5113 point2 five I'm sorry no I'm sorry this is the 5141 22 yeah um so motion to approve 514 5.22 um as a first reading and wave the second

237reading if so inclined and just to correct that it was actually 51 41.22 was the okay so this is a motion to approve board policy 5141 d22a will you please uh call for a vote truste Williams no truste Rawlings yes trusty Pearson no trusty Williamson no trusty Jones yes and the vote for that Miss gcia was just to read it for the record uh vote was um no three um yes two so that motion does not pass um and so could we we need the amended motion or or will there be an amended motion on board policy 5141 d22 I don't think there's an amend it I think there's a new could be a new motion correct you don't need amend it would if I amended that previous motion but someone can make a new

238motion thank you trusty Pearson is there a a motion for 51412276 41.2 and bring it back for a first [Music] reading is there a second second Williams thank you so that the first motion is to instruct staff to investigate the amended policy as discussed for 51412276 reading uh made by trusty Williamson seconded by truste Williams um board discussion trusty Rawlings I I think it's questions first correct yes I guess questions for staff or yes well my question would be um that generally questions be questions come before motions though so right now we have the motion on the floor and then it would be board discussion okay okay I guess my concern would be is that um I don't know how much time it would take for staff to quote unquote investigate and then how much

239it would cost if we need to go to our attorneys and um in my view um I would want to know that um it doesn't feel like it would be worth the expense um to um to change this Pol to uh change this policy because I do believe and we've experienced that is that the cdph and the health uh um the health officers when they want uh individual localities to have discretion they definitely put terms that would provide discretion to those entities um so I just think it would be a lot of expense and a lot of time that um is not necessary so I would be um voting no on uh this um motion thank you trusty [Music] PE so the motion if I heard the motion it didn't include trusty Williamson's change in

240language maybe I missed it I heard about investigating that which still doesn't even specify legal investigation and but I didn't hear the change in the the language in terms of the the phrase ology or the words change on that and um so I'm a little bit concerned about the motion itself we have a first and a second and so uh once the board discussion is over um then we can take a vote and if this doesn't pass then we can uh bring forth a new motion any other board discussion on this item trusty trusty Williams I just wanted to be clear that this motion includes legal um I say legal action but legal um advice and that's understood yes okay thank you thank you sorry trusty Jones who made the second it was uh trusty

241Williams I believe that is correct trusty Williams okay and so any other discussion trustee Pearson if it's understood Dr Churchill that it's about legal is it also understood about the language that was previously discussed by trusty Williamson is that understood too yes okay great thank you okay seeing that there's no further board discussion Miss Garcia would you please read back the motion the motion is to move to instruct staff to investigate the amended policy as discussed for board policy 51 4522 and bring it back for a first reading and and in that I would just amend the board policy is 5141 22 related to uh infectious diseases exhibit e process Check Yes trusty R the language um the once it was read back I believe it stated that um as discussed which does not reflect

242uh what trusty Pearson was talking about as far as what the language that is actually uh being investigated um so does that need to be spelled out as part of the motion um do you have that Miss Garcia from the discussion yeah I'll jump in I I I think we have it and um you know the board is requesting that we bring it back to you and and I caught it only on the second time around that you're asking for this as a first reading um so so we'll we'll bring it back and you'll have the opportunity to get multiple cracks at this okay uh okay so we have a motion and a second uh we've had board discussion um Miss Garcia will you please call for a vote trusty Williams yes trusty Rawlings no

243trusty Pearson yes trusty Williamson yes trusty Jones no so the the motion passes 3-2 moving to the next board policy may I have a motion to approve the board policy 5141 31 uh as presented approve as a first reading and wave as a second if so inclined and this is exhibit f for um immunizations so moved Williamson second Williams thank you that's truste Williamson on the um motion and trustee Williams on the second board discussion seeing that there's no discussion Miss Garcia will you please call for a vote trusty Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you may I have a motion to approve board policy 51422 as presented approve as a first reading and wave as a second uh if so inclined president Jones I'd like

244to make a motion to extend the meeting prior to that motion thank you may I have a second second Pearson thank you motion to extend the meeting by truste Rawlings and a second by trustee Pearson Miss Garcia will you please call for a vote trustee Williams yes trusty Rollings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you Miss Garcia trusty Jones could I make the motion to modify it for this next one yes so can I make the motion for board policy point2 um to make two changes or one change well to remove paragraph two and three um and bring it back as a first reading I'm sorry remove paragraph two and three and three I'm sorry to interject but technically it would need to come back as a second reading okay

245sorry come back as a second reading okay so may I have a motion I guess so to reiterate the motion on the floor is uh for board policy 51422 to remove paragraphs 2 and three and bring the board policy back as a second reading may I ask that we that U Miss Williams um amends her motion to also in the last paragraph change the word shall to May the one about like the fifth word yes yes I I'll men my motion to in to add to remove sh and replace it with may I so let me read the motion back uh okay to remove paragraphs 2 and three and in the last paragraph replace shall uh with May or No Yes shall to may or may to shall from shall to me okay and and

246and to bring it back as a second reading that's the motion on the floor may I have a second second Williamson thank you so truste Williams with the amended motion truste Williams with the second uh board discussion trustee Pearson uh this is can I ask a question of one of the trustees yes this is board discussion okay trustee Williams uh why did you want those two paragraphs removed um the first paragraph Was was exactly what we had before is was reiterating the same thing um the second paragraph is stating that all students will be have an opportunity to be given a program a safe routs program which we don't necessar we don't have so it's not it's the language in terms of program would actually it's we don't have that so I would hate to

247add more to um what we currently have is we work with the city to create um strategies but we don't what we're saying is I'm removing this requirement to have a program for each student and this third paragraph states that we would appoint a program coordinator when we currently have City School City Schools meeting and it's usually the President and Vice President work with the city along with along with superintendent thank you trusty Rawlings thank you for that um uh definition or explanation and um I would not be in favor of completely removing these I would be in favor of reflecting what currently is happening um but by completely removing these um it looks like we are you know not going to um have Equitable access and it doesn't look like that we have any

248coordinated effort so I would not be voting in favor of the current motion on the floor thank you trusty Williams the first paragraphs on the last sentence States ex what we are currently doing which mean States superintendent or design shall develop and Implement strategies to establish and encourage safe routes to school program activities and we are currently doing that thank you truste Rawlings and from my perspective that um uh that um that if we're doing the strategies then it seems like the policy is stating here that those strategies have to include Equitable access which I'm in favor of um and even if it's not happening maybe it should be happening then um and that the policy would force our hand on that um and then the other side would be um uh there's a difference

249between in my mind there's a difference between establish and encourage safe routes and Implement strategies and um coordinating a program so again I would be in favor of modifying the current language but I would not be in favor of just striking it thank you trusty Williams the the only problem I have in terms of creating what we're currently doing which is Sten and what you're mentioning is our kind of our hands are tied because we we are to do a a program like this we are working with the city and sometimes the city is not available or you know has other priorities so that's why I don't want to require us to do something when we're when we're required to be working with the city and does that make sense and so okay any other

250discussion seeing that there's no more discussion uh Miss Garcia will you please call for a vote or I guess but the will you please read the amended um policy so that trustees understand what they're voting on um board policy 5142 point2 to remove paragraph 2 and three and last paragraph replace shall to May to bring the board policy back as a second reading thank you trustees uh Miss Garcia will you please call for a vote trusty Williams yes truste Rawlings no trusty Pearson yes truste Williamson yes trustee Jones yes thank you trustees uh may I have a motion to approve board policy do9 um exhibit uh H hate motivated Behavior as presented I'm I'm sorry as present I'm sorry go ahead okay as presented approve as a first reading and wave the second reading if

251so inclined I move that we amend what is presented to move the two in in um board policy 5145 point9 to move the two itemized lists to um an AR but approve the uh for for a first reading and approve uh and wave no and actually it does and to bring it back for a second reading okay so to reiterate the motion is to uh approve moving two the two itemized lists to the administrative regulation um for 514 45.9 and to approve uh to bring it back as a second reading that is the motion on the floor may I have a second Pearson second thank you uh board discussion truste Pearson trustee Williamson can you explain why you wanted that move to the AR yes the level of detail that's presented in this board policy

252is not typical for a board policy it it did it really belongs in an administrative regulation when you get into the weeds like that really that those two lists are not policy those are implementation so that so and I I discussed it with uh Dr Churchill and um he was fine with moving it to the to the administrative regulation thank you any other board discussion okay seeing that there's no board discussion um again this is approving 5145 do9 with the amendment of moving the two itemized lists to the administrative regulation associated with this policy may miss Garcia we please call for a vote oh and to bring it back for a second reading Miss Garcia we please call for a vote trusty Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes trusty Jones

253yes thank you trustees may I have a motion to approve board policy do12 uh as presented approve as a second reading if so inclined so moved Williamson thank you second trustee Jones so motion by truste Williamson seconded by trusty Jones for discussion seeing that there's no oh I'm sorry go ahead I was trying to raise my hand sorry Rusty Rings um I I was um I wanted to um not wave the second reading and um uh and have more background information on when the um uh on when these searches occur and um what type of um under what circumstances these types of searches okay so we have a motion in a second on the floor if it does not pass we can bring back a new motion Miss gar any other board discussion trustees uh

254I'm Sorry Miss Garcia you please call for a vote have a discussion I just had a question for trusty Williams uh truste Williams which trusty willings which um what are what are you interested in I'm just curious I'm just concerned about um uh the searches of um student property um by um it talks about school officials but then we also have um the resource officers so I just wanted to have I wanted to um I wanted to kind of get some distinction between school officials and uh and officers and under under what circumstances police officers would be um doing searches um to where let's say principles would be doing searches and what Authority it would take so your request is to bring this back for a second reading but get more information I'm sorry yes

255that that's that's what it would be that but because we have a motion I just wanted to put it out there as part of the discussion to say that um that I do have concerns about that that I would not I'm not in favor of the motion as it stands on the floor now thank you so is this a request for more information from staff like that you would need consensus for yes I mean that was the um but you're absolutely right the motion would have to die before I could make that request thank you so I just but I wanted to let folks know that I am not in favor of waving the second reading okay so the motion on the floor is to any other discussion okay seeing that there's no discussion the

256motion on the floor is to ex um approve board policy 5145 do12 as presented approve as a first reading and wave as a second Miss Garcia will you please call for a vote trusty Williams no trusty Rawlings no trusty Pearson yes trusty Williamson yes trusty Jones yes so motion passes 3-2 uh thank you trustees on board okay may I have a motion to approve the board policy 6111 as presented approve as a first reading and wave the second reading if so inclined and this is school calendar don't moved Williamson thank you second actually I have trustee uh Williamson as the first and seconded by trusty Pearson board discussion seeing that there's no discussion Miss Garcia will you please call for a vote trustee Williams yes truste Rawlings yes trusty Pearson yes trusty Williamson yes trusty

257Jones yes thank you uh may I have a a motion to approve the board policy 6158 as presented approve as a first reading and wave as a second reading if so in climed I would like to make a motion that um we uh that we change the word the second in the second paragraph that we remove um the word a charter and approve it as a um first and W the second with that removal and I'm sorry in what paragraph paragraph where it states um uh an alternative school or program of choice a charter school and or online course so just the term a charter school a charter school in second paragraph Okay so the motion on the floor has been amended to be approved policy 6158 uh with the removal of the words a

258charter school and second paragraph As presented and bring back as a second reading may I have a motion I just made the motion I'm sorry I'm sorry I froze there for a second who was the motion made by I'm sorry I thought I made the motion but oh yes yes I apologize so move so seconded I believe that Miss trusty Rollings asked that we wave the second reading I don't believe that she said to bring it back for a second oh you said wave second read I'm sorry I Mard that that removal with the removal to wave the second read okay so let me restate that then uh the motion on the floor is board policy 6158 to remove the words a charter school and wave the second reading do I have a second I

259will second it for purposes of discussion thank you so truste Rawlings on the motion truste Williamson on the second board discussion truste Williamson um first of all I'm not comfortable uh waving a second reading if we've made a change I I believe that on the other items that we've discussed tonight if there were any changes we had them bring it back so I would I will be voting against this motion because I do not support waving a second reading if a change has been made thank you trusty Williams thank you I have a question and it's for staff and it's and I just thought about it because I just looked at the um um the actual um the actual for um what is it called board the actual board policy it states that it's new

260but we currently have a board policy five 6158 we we put new because of the it is it technically we didn't know what to check there because it is coming back as a first reading again um you know because it was technically approved and then brought back so okay you recall at the last meeting we approved it and we promised we' bring it back again as a first reading so it didn't fit any of the three categories that we have okay so it's not okay I just want to make sure I'm like why not a brand new thing it's exactly what you saw before correct okay thank you I just need to Pearson is that for trustee Rawlings why the change of the two words a charter um because we've um over the last several

261years we have actually uh passed um resolutions and um other aspects um basically stating that we as a school district can um we perform these functions uh as Charters do and um and my view that this does this would allow um the district if we were not sitting in these seats or the superintendent is not sitting in these uh current superintendent is not sitting in these seats that um that there could be a charter developed to implement our independent study program and I think we have a very strong independent study program uh now through um through our current schools so therefore I wouldn't want to have that in policy and it it basically taking it out reflects the values that we have had as a board for the last several years thank you and I

262also had a question go ahead um uh parliamentary wise since I'm the maker of the motion can I amend my own motion Dr Churchill yes I I think we've we've allowed that past okay um I'd like to amend my uh my motion and to remove to uh bring it back for a second reading instead of uh Deni or um not have a second reading thank you that amendment I was okay I was going to say I would second in to I would second that okay so truste Rawlings amended the motion to remove waving the second reading and to bring it back um with the trustee Williamson seconded so um with that amended motion board discussion sorry trusty Jones that's coming back for a second reading yes okay thank you yes trusty Pearson um I will

263be voting against this motion because um it may have been the vote of this board I don't know if it's the practice of this board to vote against Charter charter schools so I I don't see that the same way thank you uh trustee Williamson yes I I also actually want to clarify that when we have had Charters um schools approach us we have looked at it on an on an individual basis I don't believe that we have a policy that says that we are not in support of charter schools we have looked at the specific Charters and have found deficiencies so I I want to clarify that we have in in my mind we've never stated that we are anti- Charter we so um anyway I just wanted to clarify that thank you any other

264discussion there's no discussion may I uh Miss Garcia will you please call for a vote trusty Williams yes truste Rawlings yes trusty Pearson no trusty Williamson yes trusty Jones yes okay that brings us to the end of item 8.9 it's uh 1016 this is the um we're moving to item 8.10 revision of board policies second reading um and this again trustees is a discussion action item do and I will turn it over to Dr Churchill uh if you recall at the last board meeting you reviewed this policy recommended we make a change and bring it back for a second reading and that's what we've done thank you Dr Churchill any questions for staff on this item seeing that there's no questions uh for staff may I have a motion to approve the board policy 6115

265as presented and approve as a second reading so moved Williamson thank you second Rawlings thank you so motion by truste Williamson seconded by truste Rawlings uh board discussion I just want to say thank you staff uh for the work on this one um Miss Garcia will you please take a vote truste Williams yes truste ings yes truste Pearson yes trusty Williamson yes trusty Jones yes thank you this brings us to uh part nine governance team requests and reports are there any governance team reports I have one quick one I just wanted to share with the team that we held our first sdcba meeting of the year on September 13th so this past Monday uh we will be moving them to the third Monday uh going forward the group had consensus for that we opened the

266meeting with a round table to discuss how reopenings of schools have been going for everyone around the county we discussed covid case counts and mitigation strategies uh best practices and what's working and I'm proud to say that uh you know our case counts were in you know in line with large districts and that the the accounts were were low relatively speaking and then uh a long discussion on substitute shortages and what what teams are doing um there were long discussions about cba's recent webinar I don't know if you all saw that about governing disorderly board meetings uh it is available um on recording the County's Pacer Michael and zunza shared that um the recording of the webinar would be in our inboxes this week in case you missed it we also passed a 2122 budget

267and there was a brief update on the new CIF Athletics Health mandates the group is working on providing programming for the remainder of the year that would be of interest to regional board members including a csba road show and uh I should have more information about upcoming Plans by our next meeting um they're still confirming guest speakers any other reports seeing that there are no other reports are their governance team requests trustee Williamson thank you and and have spoken with the superintendent about this request and he agreed that this is the appropriate venue to make the request there have been discussions and questions locally and nationally about the specific content included in the social emotional learning curriculum in schools I request that we use parent University to address the topic of our curriculum related to

268social emotional learning in order to clarify what is and is not in the curriculum we Implement in Carl's bat these presentations would be recorded and made available on our website and so I asked for uh my uh show of thumbs by my fellow board members if they are interested in providing that request thank you uh this is a request uh so if trustees could show consensus by thumbs and are you my thumb is up thank you trusty Williamson so that's five thumbs uh trusty Rawlings are you calling on me for my request yes your hand was up thank you um I um I did not have an opportunity to speak to the superintendent about this because as we were going through board policies um I it made me think that maybe we need a process

269in order to do that and maybe not at meetings um therefore I would like a um I'm requesting that a agenda item be placed on our um uh a board meeting doesn't have to be the next board meeting but soon that um uh could discuss a a mechanism to review board policies prior to them coming to our meetings that are reflective of Carl's B but it would have to be an agenda item so we could discuss it okay um so my request is to place to uh to place an item on the agenda to uh to form an ad hoc committee to review uh board policies prior to them coming to a uh board meeting so that's two motions or I heard two requests one was to review all of the polic as an agenda

270item at a future board meeting and then in the second was to form an ad hoc committee no no it's one it's one request but it's again it's restate the request okay and the request is that a item be placed on a future board agenda that would that that would form an ad hoc committee to review board policies prior to them coming to an official meeting okay is there consensus for this item so if I can just interject very briefly so I uh feel they need to clarify ad hoc board subcommittees are formed to um solve onetime problems right they they meet they address an and they disband um board policy revisions is something that's going to happen at every meeting um until the end of time so so I I think if we wanted

271a board subcommittee it would need to be a standing board subcommittee um I don't think an ad hoc board subcommittee could could accomplish the the tasks I could change my request and again it's it I know I'm not supposed to be discussing it I just want to make sure that it that and I item is placed on agenda on a future agenda so we can discuss the item yeah I that I think that makes sense if if your request is that an agenda item be placed in a future board meeting to discuss the mechanism for reviewing board policies in advance of bringing them to the board I think that was what you stated first and that that thank you Dr tro that's exactly what I meant thank you so is there a consensus for this

272trustees show of Thumbs I don't see trusty Williams trusty Williamson trusty Williamson I'm sorry um so we're asking for an agenda item to discuss the board reviewing board policies before they're presented I I guess maybe I need to hear Dr Churchill's interpretation a little bit more because I my inclination let me could you say that again yeah so so as I wrote it an agenda item be placed in a future board meeting to discuss a mechanism for reviewing board policies prior to bringing them to the board and um the the item itself would then give the board the opportunity to discuss should there be a board policy subcommittee should staff have more specific instructions on what to do to bring it in advance uh timelines process that sort of thing I think it's a wide

273open discussion right now not limited merely to a board subcommittee okay then my thumb will be up okay so five thumbs for that um any other request I have I have a request um my request is Staff has advised that the city of carlbad is experiencing a lifeguard Staffing shortage at the Monroe City Pool I'd like to request that staff pursue a possible joint use facility agreement with City staff to allow schools to continue offering use of the pool for classes during school hours and for after school athletics team sports may I have uh thumbs yes thank you I you have five thumbs for that thank you trustees any other requests seeing that there are no requests uh let's see um this brings us to part 11 and 12 adjournment the the board meeting um

274it is 10:26 and this meeting is now adjourned our next regular board meeting will be on October 13 2021 at 6: p.m. the location of the meeting will be determined and published at a later date thank you to everyone and good night thank you to staff good night board members good night
