014signal ing programs like Equity training that are divisive and racist a couple months ago it was the priority of the US government to fly the pride and black lives matter Flags over the American Embassy in Afghanistan now the Taliban flag is flying in Cabell why bring up Afghanistan it is a timely example of our leaders elected and unelected being diverted by woke virtue signal exercises that have real life consequences resulting in colossal failures our school boards are spending ridiculous amounts of money on virtue signaling with woke policies like implicit bias training Equity planning contracts voting on pride month resolutions and in the name of equity cancelling advanced math for everyone until they're a senior our children are paying the price we We are failing an entire generation of children teach our children math science literature
015and Civics not privilege not ideology do not train our children to be social justice Warriors lastly parents have the right to raise and form their child not the state why are we taking orders from nameless faceless unelected bureaucrats at the cdph who are these people parents have the right to choose to mask their child or not the Declaration of Independence reads all men are created equal they are endowed by their creator with certain unalienable rights that to secure these rights governments are instituted among men deriving their just powers from the consent of the government I repeat governments derive their just powers from the consent of the Govern well we the people do not consent unmask the children educate do not indoctrinate we will not stand for an entire generation of American children to be uneducated

017mandate and the strong opposition to critical race Theory under the guise of diversity equity and inclusion you have decided to listen bend your knee to a higher power the teachers union while the teachers union set impossible standards to open school without a math mandate due to covid-19 a bar that changes as needed can never be met with unreliable and faulty covid testing for a virus that has never been identified all the while the real danger is cancer if a person is diagnosed with a cancerous tumor the immediate goal is to seek treatment and defeat the growing cancer that will lead to their death teachers union are a cancerous tumor in California and all across the country as unions make more and more impossible demands which this school board and others cave into not asking questions
018on the science relied upon to make these decisions not taking a stand against the demands of the teachers unions giving them ever increasing power so unions that make even more demands with no treatment or any action by School Board the cancer grows as the corrup unions gain more and more power and control the quality of Education declines a cancer patient with a growing tumor education in California is dying everyone can see the failure everyone can see the decline everyone can see the anxiety and the depression in the students this school board can see carlb education is dying but they would rather let the education die than stand stand up to teachers union parents wake up this school school board will never put education in your child first they will sit by the sidelines and watch
019the death of our schools in carlbad offering nothing to students but a terrible learning experience with unmotivated teachers who care less about the students their Futures their lives if the teachers cares if the school board cared they would cut the cancer unions out which they right now are leading to the death of California education write down the names of these board members carry the names with you Claudine Jones Ray Pearson Kathy Rawlings Veronica Williams Alisa Williamson never let anyone on this board ever be elected to the school board or any other elected office or office appointment ever again they failed our kids thank you thank you this brings us to the consent calendar uh part six item 6.1 approval of consent consent calendar all matters listed on the consent calendar are considered by the board

022says stated and trusty Rawlings was the second uh is there discussion trusty Pearson uh trusty Williamson I would this also include understanding Florida's protocols um as a as it um as it includes with the Delta variant so we know ahead of time if they have the protocols in Florida to protect our kids yes thank you any other discussion trustees thank you seeing that there are no other questions Miss Garcia will you please call for a vote Williams yes truste Rawlings yes truste Pearson yes trusty Williamson yes truste Jones yes and just to confirm Miss Garcia you you captured the two amendments uh presented and approved by the board by Miss Williamson correct thank you uh all right trusty Williams for items 6.4 and 6.5 thank you thank you trusty Jones um I pulled items 6.4
023and 6.5 because I will be abstaining from voting on this item city of carlb is listed on both the contracted service Services report and purchase order register and my company previously has worked with city of carlbad while no material conflict of interest exists out of abundance of caution I want to avoid the perception of a conflict of interest thank you thank you any other discussion trustees I guess I have to call for a motion may I have a motion to approve items 6.4 and 6.5 so moved Williamson thank you thank you so by motion of trustee Williamson and trustee Rawlings uh board discussion trusty person your hand is up thank you miss seeing that there's no discussion Miss Garcia we please call for a vote trusty Williams abstain trusty Rollings yeah trusty Pearson yeah yes
024trusty Williamson yes trusty Jones yes thank you everyone this brings us to part seven and item 7.1 covid-19 update and what to expect for the 2021 22 SK school year trustees this is an information discussion item uh as let's see and for this I'll turn it over to Dr Churchill thank you trustee Jones give me a moment while I pull up the slide deck I just wanted to remind trustees as noted in our governance handbook we'll hear staff's presentation and then we'll hear public comment followed by board questions and discussion thank you all right uh good evening trustees and staff um we're going to move through this item quickly this evening um have three parts uh for first we'll give you some updated Public Health Data and vaccination information pertinent to the reopening of school
025part two we'll reiterate some of the cdph rules and mandates in effect I'll highlight a few of those uh and then uh Dr NY and I will go through the mitigation strategies in place uh for a successful school year to begin I want to be crystal clear that our priority is to keep students and staff safely learning in the classroom top prior prity is to keep kids learning at school our mission as I stated earlier is to provide every student an extraordinary education in an inspiring environment uh I pulled this evening some data from San Diego County they have moved to updating their data on a weekly basis fortunately they do that on late Friday afternoons generally around 5:00 pm so I was able to pull from the County website uh some uh specific information
026apparently I made a mistake on the slide and didn't include oh my goodness ah well hold on just one moment see if it works I apologize there we go if I refresh here we go I was refreshing that earlier and uh we're happy to have up-to-date information so this is as of today um about an hour ago uh We've shown this slide before the county publishes this uh it shows really the well it's covid cases in our County by illness onset date and you can see three uh kind of waves here last summer you saw case rate uh go up you know topped out at about 750 cases a day over the winter you saw this big Surge and at one point we were up to you know over 4,000 cases a day here we
027are now in the summer again we're back at about the level we were in February in terms of case counts uh you know we haven't quite hit 2,000 cases a day so not nearly as bad as it was uh in the the middle of the winter and the big difference today is we've got vaccines widely available uh the county is disaggregating their data now by fully vaccinated and not fully vaccinated residents you can see here that currently per 100,000 residents we're at a case count of about 28 uh 28 positive cases per 100,000 residents and this is a a period of a week uh a week's time at the end of July it's the most recent data that they're they're looking at what's what's interesting here is you'll see that the um case rate for
028fully vaccinated individuals uh is six for 100,000 and the case rate for not fully vaccinated individuals is uh 55 for 100,000 so as the county notes Here case rate for not fully vaccinated residents is nine times higher than that of fully vaccinated residents uh the city manager a week ago dropped this uh chart into his weekly update um showing hospitalization rates in an infographic form um this was a period of a month uh from mid July to Mid August uh there were 13 Hospital izations of fully vaccinated individuals in our County over that period 521 hospitalizations of not fully vaccinated individuals and as they note here the hospitalization rate for not fully vaccinated residents is 51 times higher than fully vaccinated we look to see because it's of interest to know um locally what our
029vaccination rate looks like uh so I've got four data points that I pulled today uh first here the top row in green um cap captures everyone in our County ages 12 and up and and as of today the county reported that that 75% of County residents 12 and older have received at least one dose of the covid vaccine uh when we look um at the North coastal region the the county disaggregates data by regions we are in the north coastal region and we're lagging about 9 percentage points behind the county average um um just over 2third or right at 2/3 of our um North coastal region residents have received at least one dose of the covid vaccine uh they also disaggregated by age group and so uh in the 12 to 17 ages 12 to
03017 age group across the county uh nearly 64% are uh vaccinated with at least one dose here in North Coastal San Diego County we again lag um about about nine or 10 percentage points behind so so over half if you wanted to look at um ages 12 through 17 here in North Coastal San Diego County over half have received at least one dose of of the vaccine um so those were the key highlights I was pulling out of the data uh it's all available there via hyperlink and I'll make sure when we post the the slide deck um it'll be easy to to link to all of the data to to read more moving on and then we'll take questions um we we'll do the Pres presentation as trusty johnes said public comment and then
031we'll go into questions and discussion part two current rules uh from cdph three important mandates that I want to touch on this evening one required vaccinations or testing for School Employees two the indoor face covering requirement and three uh what quarantine protocols and contact tracing look like uh from from the state and County so uh you're aware that on August 12th there was a new cdph order which requires School Employees uh across the state in all public and private TK through2 Schools to provide proof of covid-19 vaccination if they can't provide proof uh then they are to submit to weekly co9 testing and you can see here we took directly from the health order um they they're referring to school workers and they they are explicit that that's all paid and unpaid adults serving in
032school settings uh this is certificate and classified staff it applies to private schools uh and they also enumerate volunteers as being um uh lumped into this group our outstanding Personnel Services staff uh have developed a system and an expectation for all of our staff to uh submit proof of vaccination to personel Services uh that commence this week we expect to have that wrapped up by the end of the day tomorrow when all of our employees will have reported back for the new school year um we will then uh starting next week have a process in place for unvaccinated staff to report to a designated testing location once per week to be tested um there's no out of-pocket expense to employees um and and we're working through the logistics of uh what that will look like
033in terms of volunteers we're also working through what that will look like um on August 2nd when cdph updated their guidance for schools uh they said and I quote schools should limit non-essential visitors volunteers and activities with people who are not fully vaccinated uh particularly in areas where there is moderate to high covid Community transmission and um if I shown you all of the slides from uh County Public Health earlier you would have seen that we are um firmly in the high covid-19 Community transmission transmission banned currently um so we've made the decision that we will be requiring all volunteers to be vaccinated um what we are doing is updating our our volunteer Management Systems so so that we can put that into place uh as soon as the logistics are finalized we will um
034let everybody know and and and we'll Implement that uh starting next week we're going to temporarily restrict volunteers from working in classrooms uh until we have the vaccination verification process finalized as you can imagine um we love our volunteers and we have lots of them on our campuses with with 15 school campuses um if if there are a hundred regular volunteers on each campus that's 1500 people that we have to manage and and and we wanted to work through complying with the staff requirement first then we'll um dial in on the uh protocols for volunteers and as soon as we have that up and up and running we will let everyone know uh we are ho hosting two upcoming V vaccination clinics at carlbad high school totally optional if uh anyone students staff families community
035members want to get their fiser vaccine at carlbad high school they have the opportunity to walk up no appointments necessary on September 7th and then they'll be back to do H the second round of shots on the 28th they'll also do first rounds on the 28th and depending on what the demand looks like we'll see if we can sit some some other um appointments up now I mentioned they can walk in they don't have to they can also go to my turn.com and uh register in advance for for that um vaccination appointment as well so either walk up or uh registration in advance and we'll be pushing this out via um social media and other platforms Peach jar and and publicizing it at school sites uh number two I said there were three areas the
036second mandate I want to cover is the required face coverings while indoors on August 2nd cdph did mandate that everyone at school must mask indoors regardless of vaccination status uh we're asking students and and adults to have their masks on before entering into any indoor setting um you know we've shared previously that outdoor mask use uh for everyone adults kids uh regardless of vaccination status is optional so it's optional to mask outside it's required to mask inside uh we'll certainly support students and staff members who meet the mask exemption requirements as detailed in the cdph U mandate um we'll continue to provide masks for students and staff members if they don't arrive at school with one uh and we've worked with our principles to go through a a progressive disciplinary policy um for students in
037the case that uh those students who are not exempt and who are unwilling to wear a mask indoors so we'll we'll uh principles will work with those students and families on a Case by case bis um couple of other points to make here so uh it's the July 28th cdph guidance that says masks are required for everybody uh in K12 schools uh they also require masks for all unvaccinated individuals in other indoor public settings so it's important to know that that in San Diego county in the state of California if you're unvaccinated you are required to wear mask in indoor public settings um right around that same time the CDC issued some recommendations uh and they were recommending they still are that um fully vaccinated folks uh uh continue to use face coverings indoors the
038American uh Academy of Pediatrics uh last month and this month reiterated that that in order to keep schools open because iners learning is our top priority everyone ought to consider Universal masking so down at the bottom I just just want to make sure that everybody understands our county is currently considered by the CDC to be an area of high transmission in order to minimize possible disruptions to inperson teaching and learning we are strongly recommending that everyone regardless of vaccination status we face covering indoors while in all of our school district facilities uh last uh mandate that I'm going to cover here that's the quarantine piece so um it's a little bit complicated uh a number of months ago the decision tree which was developed collaboratively with San Diego County Public Health and the San Diego
039County Office of Education the decision tree was like one page and it was pretty simple and easy to follow um they've recently updated it so that there are um a number of different quarantine requirements for close contacts based on the individual's vaccination status based on the location of exposure and based on whether the close contact is a student or an adult so we tried to break it out here um number one students and adults if you're vaccinated in any setting you're a close contact you get to stay in school uh we're very happy about this it this allows us uh to continue teaching and learning so if you're vaccinated student or or adult um and you are in close contact you do not need to quarantine uh for students if you're unvaccinated and if the
040close contact occurs at school then public health will evaluate a number of factors and in many cases they're going to allow students to remain in school um as long as everyone was wearing mask at the time of close contact and as long as the students will submit to covid testing twice a week for for the the period of of modified quarantine so um number one and number two they're both ways that kids can stay in school uh so we shouldn't be quarantining whole classrooms like we were last year uh number three uh cdph and and the county are clear that um if students who are unvaccinated are close contacts of a covid-19 positive individual outside of school then uh they must be out of school for 14 days so that's when I said that the
041setting is important if they are a close contact at School most likely they'll get to stay in school if they're a close contact outside of school uh at home or you know daycare or some other place then they're they're going to be required um by County Public Health to remain out for 14 days for adults uh unvaccinated adults in any setting um depending on the situation will either return after 10 days or 14 days and the decision tree spells that out and then finally here if you are uh covid-19 positive not a close contact but actually positive then uh you have to be out for 10 days plus you have to have improving symptoms and you have to be fever free for 24 hours so there's a lot there um Dr NY can cover it
042in a little bit more detail and we're certainly H happy to answer questions a little bit later um so last point for me on this one and I just want to be Crystal Clear Health departments are responsible for leading case investigations contact tracing and outbreak investigations generally public health is going to ask us for some help in identifying exposures um sometimes they're going to rely on us to identify work workplace contacts in other cases public health is going to do it on its own and not even contact us um but after the investigation is completed this is what's critical for you to know schools do not determine the length of time a student or staff member must quarantine that is determined by local public health not by individual school districts often times we're the messenger
043we're the one delivering the news to the student or the staff member about quarantine um but but we are working with public health and they make the call uh third part uh mitigation strategies um I'll turn it over to Dr NY after this slide I just want to highlight as we've been talking about for a long time now layers of safety bundles of mitigation strategies are going to put us in the best position to keep kids and and employees at school learning on campus uh so we've got a number of layers here vaccination or weekly testing for School Employees coaches Subs volunteers Etc um that's that's a powerful layer uh the availability of vaccination for students ages 12 and up that's a powerful layer staying home when sick symptom and temperature self-c screening at home
044the contact tracing and as I as I noted the ability to have a modified quarantine where kids stay in school and and go to testing twice a week uh that's that's an outstanding change they've made ought to help us keep a lot more kids uh in the classroom face coverings indoors as required hand washing hand sanitizing reduced class size especially at the elementary level we've been able to bring class sizes down more space in the classroom um we also have added counselors and additional mental health support um we we're looking forward to to to to those people as well cleaning sanitizing disinfection um filter replacement we've upgraded our systems with murf 13 filters we've installed he air filtration systems and we've increased ventilation uh wherever possible so we're we're confident uh that we did not
045see massive outbreaks in the spring um and that was before vaccination was widespread so we'll continue to implement these layers and uh and look forward to a really positive year with that I'm going to turn it over to Dr NY he's going to talk through um some additional detail in a few different different areas thank you president Jones trustees and Dr Churchill yeah as Dr Churchill mentioned we're just going to highlight a few areas give you a sense of what school will look like hopefully uh the upcoming months and give parents a flavor of that as well in regards to food nutrition um similar to last year all School meals will be free uh for all students and that includes breakfast and lunches we're going to try to maximize physical distancing while students are eating
046especially if they're eating indoors we're going to continue to clean frequently touched surfaces um and also uh we will phase in things like our salad bars at our elementary schools as appropriate we'll continue with the prepackaged food items individually wrapped fresh fruit and other uh fresh fruits with inedible peels next slide please in regards to assemblies and school-based Gatherings assemblies Outdoors are perfectly fine as Dr Trel mentioned you can have assemblies Outdoors um and those can be conducted uh without Mas indoor assemblies are a little bit more complicated at this point in time we're not recommending them contact tracing gets a little bit challenging in those cases so we've advised principles to try to steer away from those rainy days similar as before uh we'll utilize nprs uh if we need to as well as
047classrooms uh spaces um for lunches potentially and even uh snacks and meals we'll try to maximize spacing while we're indoors on rainy days and then out out outdoor school-based events um are allowed to occur these these could be athletic events uh you know anything from performances live performances we'll follow the guidance regarding face coverings but outdoor events um there's there's no uh physical distancing requirements and also no attendance limits for any outdoor events next slide please back to school night as Dr Churchill and mentioned the idea of limiting non-essential visitors on our campuses at this point in time uh we're asking our principls to conduct and facilitate virtual back toschool nights for the 2021 22 school year so principls will be sending out information on what those will look like um and how uh they'll
048be communicating with teachers and parents to give parents critical information regarding back to school next slide please indoor instruction um indoor instruction will uh pretty much go back to pre-pandemic uh um times students can participate in small group instruction mixing of student groups so the cohorts um uh can can mix from one group to the to another um students can also go to libr Library check out books um they can work collaborative lean groups we can do pull out sessions pushin sessions um and students are allowed to kind of rotate through stations as well so we're excited about those um additions we think that will help academically next slide please Outdoor Learning options as as Dr Trel mentioned before uh we'll continue to work with our principles regarding Outdoor Learning spaces whether they be um
049break that allow students to get outside take their mask off get to a shaded area where a teacher can uh provide some instruction outside uh We've uh ordered a number of uh additional outdoor Sage shade structures which we already had a number at all of our school sites so we'll continue to try to utilize that outside space uh one of the you know areas that we're still working on is that outdoor Wi-Fi project we and anticipate that to go out to bid on September 1st uh aiming to bring that uh for board approval on in November so one of the challenges will be um again outdoor Wi-Fi access for our students but we think it's a good option for classrooms to get out there to have a mass break besides just lunch and any any
050type of outdoor activity that they're doing through lunch and break next slide please self-screening as Dr churchilla mentioned before uh we are asking all families to self screen prior to sending their child to school um we think that that uh is a huge help please don't send your child to school if they're symptomatic if they're have a fever if they have any of the symptoms um that will complicate obviously uh contact tracing and and sending students home so next slide please uh covid testing for students so as Dr Churchill mentioned were um encouraged by the uh recent uh decision tree where we we can do some modified uh quarantining um in this case we've uh elicited a company that we used last year uh to do some of our student testing with our student athletes
051and that's Inspire Diagnostics uh they um provide all the testers uh they conduct PCR testing and they've uh traditionally have about a 24-hour turnaround time we've uh elicited them to be at four locations five days a week for our students and those locations are listed above two elementary schools and two high schools and they're going to be there um before school as well as after school to test students um each day next slide please so a lot of text here and I think Dr Churchill did a really good job of explaining the quarantine protocols as he mentioned before you know we are not contact tracers oftentimes we're the ones doing the investigations uh when we're notified from the county or from a parent that we have a student or an employee that um is covid
052positive we're the ones going in and investigating um you know where are the close contacts who are the close contacts and then um working with parents on quarantining rules BAS B on cdph and local public health guidelines um you know he he did a great job spelling this out so I'm not going to go through this um Point by Point only to say you know again that modified quarantine is um The Hope is that we are having to um not have to quarantine large number of students next year um if uh the students are in close contact of another posit positive uh student or staff member they have that ability to uh conduct the testing twice a week and still stay in school which we think is a real positive thing to keep kids connected
053in school instruction next slide please a couple other um items that tend to get a lot of questions that's physical education so again um as long as they're participating in PE outside they're allowed to engage in all those activities on masks uh if they are doing any activities inside students are required to wear mask and that includes locker rooms changing out for locker room uh inside and then Visual and Performing Arts specifically more Performing Arts but band inquire practices rehearsals can take place indoors and we do have PPE equipment for um our students at each of our campus campuses we um just went through another reorder of some of that equipment for the instruments as well as student mask um otherwise uh students can participate Outdoors for rehearsals as well um and they can do
054that on Mas orts we're still waiting on some guidance the last guidance we had was April 6th and that is no longer in effect so we really don't have um a ton of guidance for the fall at this point in time we're eagerly anticipating some guidance to be released uh by either County Public Health or cdph next slide please um cleaning the same protocols as last year will continue to follow CDC and cdph guidelines um they're cleaning surfaces uh daily uh they're focusing on high touch areas and they're continuing to thoroughly clean and disinfect any areas where we've had um some exposure next slide please uh lastly I just like to say that um all of this information is listed in our 2021-22 health and safety plan our covid-19 health and safety plan which is
055on our website we'll be communicating this out to families as well um in a couple different Communications that go out in the next few days where this information is there there's a lot more information as a matter of fact I only highlighted just a few um to give uh families a little bit of a flavor of what to expect next year um but this is all listed in detail on our website and we'll be sure to communicate that out to families moving forward next slide please so I'll turn it back over to president Jones who will start public comment thank you Dr NY and thank you um to instructional services staff and really everyone on staff for their presentation uh tonight trustees we have 15 Reg registered speakers on this agenda item as noted in
056our agenda for each agenda item no individual presentation shall be for more than 3 minutes and the total time for this purpose shall not exceed 20 minutes trustees in order to hear from as many speakers as possible I recommend we decrease the time for each individual speaker to two minutes and extend the total time for comment on this item to 30 minutes trustees may I see your thumbs and support of this change thank you all ordinarily board members will not respond to presentations and no action may be taken however the board may give direction to staff following a presentation speakers uh as with oral Communications we ask that you state your name and indicate whether or not you live within the boundaries of the school district our first speaker is uh Rachel Marino a you
057will press star six to unmute and Dr Churchill could you put two minutes the timer on the screen I will so yep two minutes per and you said would' extend it to 30 minutes over so we have 15 speakers times two is 30 minutes so we've extended the total time and each speaker will have 20 minutes that way we'll hear from every speaker tonight who submitted a card uh and so speakers you'll press star six to unmute and Dr Churchill will have um the two minutes on the mic we'll do our best to indicate when you're getting close to your time uh and then your mute your mic will be muted at the end the first caller as I said was Rachel Marino a the number is 5555 good evening can you hear me yes
058go ahead good evening trustees superintendent Churchill my name is Rachel marinat teacher at Sage Creek High School mother of two CD students and Cuda Union president I believe a quote by Maya Angelou best describes how the district has functioned in the past 17 months she said do the best you can until you know better then when you know better do better at every turn we're learning new things about how to best respond to and mitigate the effects of this pandemic so often in the months past it was hard if not impossible to know the best thing to do but in listening to the cdph and other experts who know best how to handle such an emergency the district learned and did better with the layers of mitigation strategies in place last year we brought back
059students who wish return to in-person learning this summer an unprecedented number of students and teachers were able to learn teach play and stay safe on campuses using all of those protections as teachers across the district prepare their classrooms to welcome new students we know it works to keep students safe and we're ready to meet the challenge ventilation cleaning vaccines testing masks these all have been working together to keep our community safe and will continue to be the way that we keep our schools open and our students in classrooms this year will bring its own challenges I know know I'm not alone and looking with dismay at where we were in June and seeing where we are now I miss a return to normal that seems further away than it was just two months ago I
060know that I'm not alone in feeling frustration with all of the changes that this virus brings but I also know that what we know changes all the time science which feels like it should be definitive and unchanging instead Embraces the changeable and blurry aspects of life it is helpful for me to remember that it was also new discoveries that changed the Beloved dinosaur brosaurus to an aot Taurus and back again and it was the adoption of a formal definition of planet that reduced the number of planets in the solar system from 9 to just eight reclassifying Pluto as a dwarf planet as a parent and teacher I know I'm not alone in feeling anxiety and concern for the humans entrusted to my care but I also know that this district is as committed as I
061am to protecting all who spend time within its walls your your time is up thank you next caller is uh Nikki Wells number 9669 And press star 6 to unmute Nikki Wells are you with us star six there you go can you hear me yes we can go ahead great good evening my name is Stephanie Wells and I'm a parent of two students in the district many of our students have stayed home the past year to protect our most vulnerable family members now that they are returning to class they are expecting you to protect them especially now that children are being impacted by the Delta variant I'm in support of the public safety rules and mandates for when school resumes on the 24th but I would like to see the district be more specific one
062Mass should be made with a minimum of two layers of breathable material cover the nose and mouth fully fit snugly against the side of the face and be secured with ear Loops or ties how the students don't need to use their hands to keep them up and be specific about no mesh masks or Gators also be clear about what the progressive disciplinary policy is do not make it a case-by casee policy if someone refuses to wear an appropriate mask they should be sent home and get no more than three chances be before being offered an alternative learning option also students who have a verified Medical exemption should be tested twice a week at the district designated testing location I think the district should also confirm that the exemption is legitimate why is this important for
063the district to be specific and clear with their requirements because we have a group of parents that had clearly stated they plan on defying the math mandate and disrupting classes we've witnessed their disruption over the summer at all the school board meetings by being specific we take the onus off teachers and administrators whose only focus should be teaching not being a bouncer at the door anyone who says that not that many kids die mortality is a pretty crude outcome to the measure of our children preventable death and Disability should not be accepted as a denominator of children with covid increases so will the bad outcomes it's math and for anyone not comfortable sending their kids to school with math this time you stay home there's a virtual option available to you let's teach our kids
064empathy and let them be safe your time is up thank you next caller is uh Marie Monfort number is 6087 Marie Monfort 6087 Maria mon Fort are you of are you online star six to unmute maybe we'll come back to the speaker Dr Churchill can you hear me oh yes there you are thank you sorry I did star stick but I had my phone muted anyways my name is Marie monforte and I have two elementary kids at Kelly I'm writing today to voice my support for mask mandates to help keep our schools open and as many children learning in them as possible I'm not here to argue about mask epic if masks were not an important part of a layered mitigation strategy neither the CDC nor the World Health Organization would be recommending them and
065if masks hurt our children the American Academy of Pediatrics wouldn't be recommending them for everyone on K through 12 school sites these National and international bipartisan organizations have the expertise to make such policy recommendations cdph and state of California guidelines respect this expertise currently mandating masks in schools further public policy Institute of California found that 75% of San diegans favor masking in public Statewide and National polls from many outlets are trending similarly and yet the conversation has been dominated by a very confrontational Fringe minority who seek out media coverage to bolster their numbers and are well funded by political interest groups with ulterior motives meanwhile countless individuals actual car's bad parents continue to thank me privately for Having the courage to speak out because they don't want the confrontation and they feel bullied into silence
066but do not re misread our silent majority the vast majority of your constituents support mask mandates and are happy to adhere to keep our schools open now we need our district and board to take a firm stand on mask mandates regardless of what does or does not come down from Sacramento you promised us you would follow the science and the experts not political agendas to keep our kids safe the CDC the who the the AAP all recommend masks in schools most especially for our elementary children who cannot yet be vaccinated you have all the support you need from your residents already so please find the courage to stand with the majority of your constituents keep your promise to prioritize to health and safety and mandate masks regardless of what comes down from Sacramento thank you
067thank you our next caller is Ashley ha number press star six to unmute hello can you hear me yes we can go ahead hello okay um good evening my name is Ashley hag and I'm the mother of an incoming kind kindergartener in the Carl dad unified uh School District I'm speaking tonight to voice my support of required masking in our schools um I know that those in support of mass Choice have been very loud and very visible um over the past past few weeks and what I didn't want was for tonight um to have their voice um be the majority of what you heard so I just want to um lend my voice in support of it um I work in a hospital as a psychiatric nurse and I see the effects that this pandemic
068has on the mental health of both adults and children on a daily basis and I have to say that not once have any of my patients ever told me that wearing a mask was the cause of their anxiety y or depression this is something that I have heard um as an argument um countless times that tries to link masking to this quote unquote Mental Health crisis that we have in children it's not the masks it's the isolation it's not being able to see their friends and family members it's being afraid of this virus and what it could do to them it's grieving the loss of their loved ones who have died because of this virus and to say that wearing a mask is really what is to blame for this Mental Health crisis is in
069all honesty infuriating if we want to give our children the best chance to stay in school and avoid missing school because of quarantines due to outbreaks like we've already started seeing in other places like Florida I ask that no matter what please continue to require masks in school thank you thank you the next caller is Bri Johnson and press star six to unmute Miss Johnson hi can you hear me yes go ahead hi can you hear me yes okay hi hi my name is Bri Johnson this will be the first year of school for both of my kids in Carl's Bad unified one is St in kindergarten and the other will be in special education preschool I fully support Universal Mass squaring in our school district with obvious Li limited exceptions made for legitimate and
070verified medical reasons or disabilities I urge the district to have a clear and enforcable mask policy in place before school starts next week there are already parents who have said that they will Coach their kids to not comply with wearing masks on our school campuses the families in this District need to know exactly how masking will be universally and consistently enforced and that parents who choose to create a deception to our kids learning will not be tolerated they always have the option virtual learning if they can't follow basic public health safety measures masks are the best protection our youngest children have until they can be vaccinated and the only hope for schools to remain open for in-person instruction is strong mask enforcement policies and procedures finally I I would urge the district to consider additional
071mitigation strateg IES for the school year while I think the measures you have outlined are all important we also need to remember that this school year is very different because the Delta string is much more transmissible one suggestion I have is weekly or twice weekly PCR test screening of students which would alert officials to covid cases even in asymptomatic individuals we need to do everything we can to protect our students health and keep schools open this year thank you thank you our next caller is Dana meter 0874 trusty Jones I don't see that caller on the line thank you the next caller is Kelly leoco uh 4955 trusty Jones I also don't see that callor on theine thank you Dr Church the next caller is sarahfina kernberg uh 8585 and press star six to unmute
072please hello can you hear me yes go ahead all right hello my name is Sarena kber and I'm a parent with three kids in the carside School District I'd also like to voice my support for Mass mandates for everybody on school grounds and vaccination or testing requirements for staff and any other measures that have been determined to slow the spread of covid-19 when it comes to public health and safety we do not allow anyone to do anything they like nor should we we do not allow drivers to drive drunk or run red lights because it directly impacts other people at schools we enact all sorts of rules to ensure the health and safety of everyone if a school can enforce a dress code they can enforce a mask mandate especially given the consequences we've seen
073around the country when they don't no one has the right to endanger my children or anyone else by sending their kids to inperson school and masks I desperately want to be done with this pandemic I think that's one thing that every body can agree on everyone just wants to be done and the way to get to that point is to reduce the spread of the virus the best way to do that is with masking testing vaccinations that is how we get back to something approaching normal there are other school districts in other parts of the country that have not done so well at masking and vaccinating and they've already had to shut down to quarantine I want to keep our kids in school and one way we can do that is by having all of
074them simply wear a mask and really I don't think the current guidelines go far enough please enforce the cdp's recommendation requiring masks for all people regardless of vaccination vaccination status instead of just strongly recommending it and students shouldn't be eating indoors at all if they're not wearing a mask for any period of time at the very least it needs to be outside thank you for your time thank you the next caller and I apologize if I get your last name wrong Chris wat wck or wadit hi this is Chris wilick um can you hear me yes go ahead um first of all I'm a parent in the district I live in the district and have a first grader um in the district currently um first I'd like to thank the board for making um what
075ended up being probably much harder decisions than they should have been over this past year because of the circus that some of these meetings um turned into unfortunately um I've never previously had to speak or or felt like I've had to speak at a board meeting because I've trusted the board to follow um state law um and state orders and also the likely practical effects that the insurers for the school district will require um for for policies moving forward um however while we've had a number of people speak already today about um supporting um the mass mandates in our schools and I support it as well um I do want to raise one potential issue to the board related to U medical exemptions um recently has come to my attention that the let them breathe
076activists that has created such a circus are sharing information with each other about how to quote get around the mask mandate or get around the mask mandate through medical waivers I've heard that they are offering to share information about friendly doctors with each other exactly what symptoms to claim and how to fill up the paperwork work um for the district this is scary if this is the same group that has members that are opposing the vaccine um what I ask for today from the board um and I realize it's a difficult place is to come up with some stringent standards for reviewing those medical exemptions also asking the board to direct schools to notify parents if any child in the classroom of their student is ultimately allowed um to have one of the exemptions there's
077been a lot of discussion about Parents Choice rights and responsibilities really one of my duties as a parent is to ensure the safety of my own child including being informed of any potential risk so that I can take measures to protect my child if an unmask student is in his class um additionally why like your time is up our next caller is uh Christine Schmidt can you hear me yes go ahead hi uh first let me say my thank you to the board the superintendent teachers and all employees of CD my family has lived in Carl's bed for 16 years and has been part of both the Jefferson and CSA communities and I have three children under 12 I would like to briefly bring to the attention of the board a peer-reviewed jamama pediatric study
078published Monday they looked at over 6,000 households in Ontario Canada in the second half of 2020 word children were the primary index case to sum up the results in brief children age 0 to 3 years and four to8 years were associated with higher odds of transmitting SARS CO2 to household contact than children aged 14 to 17 years this was Data collected long before Delta ever came on the scene we now know for many studies that kids do catch this virus they do participate in transmitting to family and community and that it's not completely harm L for them 1 to 2% of cases in kids may result in hospitalization so far but we can't forget that a small fraction of a very large number is still a large number further we can't afford to make the
079same lack of evidence as evidence of lack mistake when it comes to Long Co and kids some here tonight May advocate for what they believe are their individual rights in the face of the pandemic we don't have to imagine how this would turn out we can just look at Florida I support the other speakers propos proposals tonight regarding increased Clarity on quality of masks Clarity on defiance of policy and regular rapid andent surveillance testings of all students not just those with known exposures thank you thank you our next caller is Sharon McKean numbers 8866 um sorry trusty Jones I don't see that caller on the line okay the next caller is uh Scott Davidson 7181 and star six to unmute good evening dear trustees my name is Scott Davidson and I'm the parent of a
080freshman at cusd next week we will start a school year that is doomed to fail with the current policies in place it is guaranteed that thousands of our students will be continuously quarantined throughout the year and this week's of class time due to unnecessary restrictions a few weeks ago the UK reported that 25% of its students were out of school at one time that's 1.7 million students not being educated when only 2.8% had tested positive was Data showing that quarantines had no effect on transmission in schools the UK and many other European countries are dropping their quarantine policies altogether realizing that it is far more important for kids to stay in school than stay home to avoid a virus the DC data shows is far less dangerous than influenza or RSV what's worse is that
081we'll be relying on a testing system that is slow inaccurate and incapable of handling the volume of tests that we required Harvard Professor Michael Mina recently reported that a positive result on a standard PCR test has a 60 to 70% chance of being false meaning the person already recovered from covid and is no longer contagious the easy solution is mass deployment of Rapid antigen tests and about those masks President Biden's Co adviser Professor Michael osterholm recently admitted that when you actually look at face cloth c coverings they actually only have very limited impact on reducing the amount of virus you inhale or exhale out providing only five more minutes of protection from infection in a room than if you weren't wearing a mask by the time the morning announcements are over a child mask is
082completely pointless to protect them from the virus as you should all now know the CDC has fully acknowledge that vaccines do not prevent infection or transmission of the virus once again we find CD horribly unprepared and once again likely to overreact by closing classrooms and schools what will you do this year to stop that from happening thank you thank you next caller is Chris Balden 6443 hello hi um thank you for letting me speak tonight um listed to all the arguments tonight for the masks on you know on both sides and stuff but I just wanted to bring up the stat that um 4.2 million kids have tested positive um since the pandemic began and only 0.8 have died compared to between 2018 and 2019 488 kids died from the FL out of 56 million
083but no one was screaming about masks back then and way less kids have died at this point um due to masks I think a big hear a lot of people talking about the no Math Circus well one of the reasons that we have problems with it is we look at Gavin Newsome who's setting setting the laws down the state and he himself doesn't abide by The Mask rule he's been seen at The French Laundry with with his constituents who wrote A lot of these medical bills um these medical laws and he doesn't follow them faly himself doesn't follow them he fousy himself has said maths do work then he says they don't work then they do work so what science are we talking about and then also I I you could put on three masks
084and go to a gas station if you could still smell the gas through your masks that means they don't work try going to a gas station with one mask but when I'm saying got one child entering the uh the public school arena in um Carlsbad this year and I think that it is complete child abuse to have their little uh faces covered up if the teacher wants to get vaccinated I think the teachers should get should get vaccinated but as far as the the kids experiencing life being able to see the teachers lips move being able to interact with their kids and see each other's faces in class that's a big deal and the psychiatrist has said that's not going to have an effect on them it will have an effect on them Mr B
085time is up thank you uh next caller is Stacy Baker 0234 trusty Jones I do not see that caller on the line okay next caller is uh Kristen Foster can you hear me yes go ahead this is Kristen Foster and I have one student left in the school district in carlbad um Dr Churchill and Bor good evening as you have heard from the seven parents this evening there are clearly passionate feelings toward masks some people in favor of wearing them and those that believe that families should have mask choice I would like to remind you about what happened last year many of those same parents and board members that currently believe masking is the best course of action for our colide unified students are also the same families and board members that believed in keeping
086our schools closed last year due to fear of what may happen now with plenty of evidence to show that in fact schools should have been open all along those parents and board members must look back regretfully wishing we had in fact opened our schools in September of 2020 now as we continue to see our children suffer albeit outright or privately from being isolated and not seeing people faes and emotions Etc we will again gain the same perspective down the road what if we decide as a board and community that we are not willing to make that same mistake again the loss and suffering is too great to continue to mask our kids when the risk from covid is almost non-existent I am asking once again that you the board fight for our kids and what
087is best for them allow mask choice and let our C USD students breathe if they want to thank you thank you and Dr Churchill just to be sure there were a couple callers that weren't on the line I just want to make sure they weren't disconnected it was uh Dana meter 0874 not on the line okay and then Kelly leoco 4955 not on the line and then uh Sharon McKean 8866 also not on the line okay thank you this brings us to the end of of public comment uh see this now is the time for trusty questions on the presentation trusty questions trusty Rawlings thank you and thank you for the presentation um uh on slide 18 you talked about the vaccines being available at um I believe it was carat high school and I
088wanted to know if there was any cost to the district for those and or a resident requirement uh for within Carl's bed District no ma'am no no requirement um and no cost and I had a followup to that uh and sharp is the provider that is bringing that to Carl bad high that is correct yeah sharp healthc care um they've done lots of these clinics and they continue to look for school districts and other community based organizations to to host um from from our end we're providing a location we're providing access to power and uh and and some tables and and they're bringing everything else so we're uh we're very fortunate to have a partner like that that makes it easy it's a turnkey solution for providing vaccines to our community thank you trusty Pearson
089uh questions are for Dr Churchill um in your providing data points did you have any uh the high transmission ban was for San Diego County did you have anything for Carl's Bad uh that you know there is some zip code specific data um I know that when I glance through the report earlier this evening of our four zip codes um uh two of the zip codes uh 92008 and 92009 were higher but I I I don't know I can't remember the CDC related band so give me um if I can quickly and easily find it while we're still in this meeting I'll report back if not um I'll I'll have to get back to you on that one thank you thank you trusty Williams thank you um um Dr Churchill is the district defining what
090types of mass can be used um yes in fact uh we do have in our um Co safety plan the health and safety plan that Dr NY referenced earlier uh we do have an I quote written in their masks should be made with a minimum of two layers of breathable material cover the nose and mouth fully fit snugly against the side of the face and be secure with ear Loops or ties so students don't need to use their hands to keep them up no mask no mesh masks or Gators allowed thank you thank you trusty Rawlings thank you um and this refers to slide 21 and 32 um I want to know if the the definition for close contact Remains the Same such as 15 minutes and um uh within six feet and um is
091there any exemption for being outdoors uh in order to be a close contact Dr I I'll let you take that one sure the exemption is still the same it's 15 minutes or more cumulative in a 24h hour period uh um and six feet or less of distance and it is inside or outside thank you trusty Williams thank you um in terms of the Mask medical exemption who will be reviewing the medic exemptions um or and implementing them so similar to last year we had a a process that the covid response team reviews each medical exemption uh they're required to have a doctor's um note and then we also ask for a release of information from the doctor themselves so we continue that process uh principes collect that information they send that information on to the
092co response team and then we follow up on a case-by Case basis we did not have um a ton of medical exemptions last year um only a handful so if a student sorry have a followup let me just make sure trusty Rawlings had her hand up is this in regards to this go ahead yes it is a followup as well um is if if somebody has a medical if a student has a medical exemption um are are there Alternatives offered such as Shields and drapes and those types of things yes part of our process is we um we try to find Alternatives first um if those are still not an option you know we have some students that have uh feeding tubes as an example so we'll try to find um alternatives to that if
093it is not an option though and we do have the physician note um they are Exempted from wearing the mask per cdph guidelines thank you trusty Williams thank you so I just have a followup on that Dr n so if a student walks into the classroom without a mask and saying I have a medical exemption but no document was received they would what's the process yeah we would as as we mentioned before we would ask that student to put on a mask uh if they're defiant and they do not put on a mask um we would remove them from the classroom setting to an outdoor setting contact parents um and each cases individualized but in this case the scenario that you gave we would ask the parent if they do have a medical exemption do
094they have a doctor's note could they provide that um if so you know we could probably uh facilitate that very quickly um if we don't have documentation then we'd ask the parent the of the student that they need to wear a mask until we do thank you thank you I had a quick question on inspir services for testing and I think maybe this would go to uh well Dr NY or Rick Grove I I guess the question is is um with the testing availability um at the sites will the usage be monitored and then Services altered or is it the contract designed uh or the yeah the contract designed with Inspire to be offered for those days at that time uh through the school year they're certainly oh go ahead they're certainly flexible um we
095we definitely um have worked with them in the past so if they need to um add additional sites because of capacity issues reduce sites they they are open to that as well as um extending during the day they have some time limitations about getting the test off to uh the testing center to read those in the afternoon so four o'clock is about as late as they can go in order to turn around those tests in a you know a reasonable amount of time but the theou allows us some flexibility to add or reduce Services as needed thank you any other questions trustees one of the questions one of the final questions I had is um and and maybe staff has already answered this but uh I just want to make sure that uh the board
096hears it is can staff describe how students will continue learning while on the new modified quarantine and and what that process will look like so if a a parent opts to do the modified quarantine and elects to test students twice a week umh you know with a three-day period in between the student would continue to learn in the classroom as they normally do and uh continue to have access um just like every other student so we're hopeful that that will limit the amount of students in need of quarantine uh when we do have a close contact situation um that will allow more students to access the curriculum and to be um uh the contingency of learning um to to remain in place while they test and that's for the total of two weeks and then
097after that um they don't need to be tested anymore and they just remain in school so that's a good thing for those students who are longer could you describe just briefly what the continuous you know like how does the learning continue sure teachers are going to be required to maintain Google classrooms and at the younger level it's seesaw is our learning management system that they use um so when a student is out uh on a quarantine for a longer period of time or the parent doesn't opt to do the modifi quarantine um they'll have access to that information and then we will also also have teachers uh that have elected to do some uh live tutoring um by grade level as well as by subject area that connect that can connect with those students on
098a daily basis um and provide them extra support in their classes and walk them through any additional instruction that they need so we'll be collecting those list of names from the teachers uh when they come back tomorrow of teachers that are willing to um give up their prep period uh um to instruct students as well as any uh grade level teachers at the elementary level that uh can connect with students after school or before school and uh we'll we'll uh provide that list to any students that are out for a prolonged period of time thank you I have a followup to that trusty Rawlings is your question related to this okay the in terms of um if there are identified gaps Dr NY in subject matter with interaction uh with a live teacher in the
099tutoring scenario you described uh will staff seek out help to support those subject matters that our students are are seeking or we have some other resource for them yes um we certainly do um they you know those those students are also excused in their absences so they'll be able to make up any work that they were not able to make up um during the quarantine period uh We've we've also been meeting with some outside agencies that potentially could provide additional tutoring opportunities for students Beyond um teachers we'd like to use our teachers first uh we think that they're connected they know our curriculum um and scope in sequence we think they'll do the best job but if we run into scenarios where we're short on tutors certainly we can supplement that with an outside agency
100thank you trusty Rollings uh you you made me think of another question um is there clear instructions on how um a parent can um ensure that the the school knows their vaccination status like um if there is a child vaccinated um in order to uh streamline the process for quarantine yeah through the registration process we uh voluntarily ask for volunteers uh you know for parents to be able to voluntarily upload that information um if we run into a close contact situation um we ask parents to provide that information um through AR's Parent Portal so um those would be the two options we can certainly parents still have that option I believe to go in and and update that information for any child that's been vaccinated uh voluntarily and we can send information uh throughout the
101school year on that any other questions trustees seeing no other questions again this item was an information uh discussion item thank you to staff for the presentation this moves us to item 7.2 measure H sorry discussion I'm sorry trusty Williamson thank you yes um thank you for the presentation um next week when we return to school there will be some students who choose to wear a mask when they're outside there will also be a very small number of students who have been granted an exemption from wearing a mask indoors I invite cus parents and grandparents and caregivers to help your child understand how hurtful it would be to tease or mock or bully these students no matter how you personally feel about masking I urge you to do all you can to help all of
102our students feel welcome in our schools this year and that's all I have to say thank you thank you trusty Williams thank you um and I just wanted to point out that I appreciate staff's work and getting our students back into the classroom I have and always been supportive having our students back into the classroom with the priority for the students health and safety so thank you thank you Rawlings and I just want to say uh thank you to staff and um uh Echo um sentiments by um trusty Williamson and I was at a uh registration event today um as a matter of fact and uh it was um well attended uh the students seemed to be very happy to see each other face to face and um so it was a very positive interaction
103um and there wasn't um uh there really wasn't any negativity that I saw so um uh spirit wear was selling out and so uh I think everyone's going to be ready to get back to school and get back face space so um I was very encouraged uh by attending that event today thank you okay no other comments by trustees thank you trustees uh this moves us to item uh 7.2 measure HH Bond program update trusties again this is an information dis discussion item and for this Al it over to Mr D thank you and good evening president Jones and trustees this is our monthly measure HH Bond program update uh I will be going a little bit deeper into the budget than what we normally present uh during these updates to talk about some options
104that we might have in the future to address cost overruns that we've seen so far du due to some uh unforeseen uh circumstances in our project and also some unbudgeted uh items that were in the facilities master plan and what our next steps might be moving forward to uh help cover those costs and and perhaps bring some dollars in to uh to make sure that we accomplish as much as we possibly can under the facilities master plan um you know should we our measure HH dollars not stretch as far so let me make sure I got the right screen there okay so I'll give a quick update on project status we go through I'll just run through the cost proposals very quickly and then we'll get into the budget status following this item we have
105two design reviews that we will go through tonight those are separate items on the agenda and we do have some special guests uh who will take us through that so once this items concluded uh once I go through my presentation we'll go through our normal um round of uh discussion and questions with the Board of Trustees and then we'll take those other two items U as separate items so with uh with Kelly as the board knows uh we're resuming the work within the original project scope so we were on hold for a while uh we do have the permission to get moving and so uh our construction manager and all of the contractors uh working on site have been able to move forward with the work that was originally in the project scope uh what
106we haven't moved forward yet is the additional work that uh has been required of the storm water permits um and you design comments that have resulted from that process we are in the process of doing what we always do whenever we have changes to a project scope and that is to review the proposal on what the cost is to do a constructibility review uh with our architect and also our construction manager and also making sure that the work that our that the contractors have U have proposed uh doesn't overlap with other work that we had already had in the original scope so I mentioned this last month uh when I brought forward the proposal of the uh approximately 3.8 million uh cost increase um that was related both to the to the delay and to
107the uh additional scope of work we're still in the process of evaluating that cost proposal so I don't have anything uh for you tonight but just know that the work is is continuing you we we picked back up uh the the majority of the new work really is at the end of the projects so we do have time to do the thorough evaluation and uh and bet the costs involved uh before we bring that back with a potential cost uh I'm sorry a potential Amendment to the contract with uh with hope uh we're working feverishly on the remaining items uh I know several trustees were out there a few weeks ago uh when we did our ioc tour so it would look a lot different today uh but we are working very quickly to get
108the front of the campus open ready to invite our our students and families on day one uh we've got uh Furniture that's uh being assembled and delivered replaced back inside of classrooms um so that we can get that done I'll mention that um Mr Anderson and I will be at Hope and Kelly first thing tomorrow morning taking a look at uh where we are in terms of of status and Readiness for opening you know we we know there's still some work to be done uh in the next few days um but the purpose of that visit is to see you know what we can possibly do to help make sure that all of that work gets done on time uh and it is as seamless as possible uh when when we reopen next week uh
109I then on on Friday uh we'll also be out at magnoli which is a little further along uh and and also AOE we're we're doing some work on the new preschool spaces so we we're we will be outside uh onsite looking at those projects and uh giving support to the sites wherever we we need I mentioned on the slide Magnolia ready to go that's not exactly true uh you know we we are delivering furniture and it is being assembled uh we do have punch list items and uh you know but the Magnolia was uh was much further along and and it looks a much better shape um than the other two schools where where we've got significant construction still going on uh but Magnolia is um just about there and um we'll be excited to
110uh reopen that school to our families next week for change orders and cost proposals uh these are all items again that are within the established budgets so we've not had to uh increase the project budgets related to any of the items uh that are listed on the following Pages as you can see um these are uh relatively routine and um within the um within the project scope and within the contingency budgets sorry there's a little bit of a lag on my on my mouse here so let me get into the the overall budget status so as as the board knows measure HH was a $265 million uh General obligation Bond measure and so ultimately you know our dollars are confined by that that bonding Authority uh we've already issued two series of bonds um but
111it is a finite resource the tentative budgets that were established in the 2018 facilities master plan really were based on hard construction costs and general assumptions and so it was you know looking at the thoughts and ideas on paper um and giving the the best estimate of of what those construction costs would be at the time many of the soft costs were excluded and that can reach up to 30% of a project budget so as we look at the budgets that were established on these projects um the the soft costs will eat into that overall budget and so we've really had to take a hard look at every one of the projects in facilities master plan in every one of the phases uh to find where we can achieve savings and really hone in on
112what are the priorities at each one of our campuses uh so that we make sure that we hit the top priorities and what things are you know more nice to have items uh than the need to have items um so that's that's been a a you know a tough task on every one of the projects and it's going to continue on as we go into you know phases two three four and five uh as we have uh had our project planning and input sessions with our stakeholders and worked with our Architects to further refine the scope you know we're often coming right up against those budgets and and sometimes going Beyond and and so you know there always is a continual review of these these projects uh but another uh budget constraint uh as the
113board is aware is we've had to incorporate design changes based on changes in construction codes uh and also compliance issues that are driven by the division of State architect or our requirements to comply with the Clean Water Act so all of those things need to happen and really those are dollar one uh type of items you have to get those things done before you're allowed to do the rest of your project um the division of State architect uh is looking really hard at path of travel issues uh on school campuses and uh they're they're changing the way that they that they look at projects um whereas it used to be they would sort of look at the general area wherever you were doing renovations or new constructions you know now they're really looking from from
114parking lot to that building do you have an accessible path across the entire campus and so often um districts when when they're doing these types of projects uh are finding uh additional obstacles um that they have to overcome in order to make accessible paths in order to get that DSA approval on a project uh and again those are are must haves in the eyes of DSA before we can do U you the other items uh on a campus get there so we've also talked um particularly in the last meeting about the pandemic related cost escalation you know certainly we would not have imagined the disruption in the in the supply chain in in 2018 um you know we hope that some of that will settle down um you as we improve the the pandemic situation
115um but you know we we expect that there will be lingering effects and and that we will continue um to see disruptions and cost increases the labor short that's going on you know will also certainly be driving prices up at least in the short term uh with many of our suppliers I'll also mention that with the projects I just mentioned Kelly hope and and Magnolia um you know there are things that we've still ordered uh particularly with furniture and if you tried to buy furniture for your home you know what I'm talking about uh but we also have those same disruptions uh with many of our very reliable suppliers and Mr Anderson's done a really nice job working with our principal so that they aware of what's here what's what's still uh sitting at the
116Port of Los Angeles waiting to get Customs clearance and and make its way down here um these other items I I I won't beat them to death because we have spoken about um the the design changes um at Kelly but we also have a placeholder in the budget for hope uh we're still in the process of uh design review and approval with the city on the storm water mitigation at that campus and until we get out of that approval process um we won't have a a way to really zero in on on what the total impact will be so we we have take somewhat of a wait and see um so whereas we have 3.8 million uh because I I put in the all-in cost right now on on the budget for for Kelly hoping
117to to bring that down uh right now we have a $2.5 million placeholder with hope and that's a combination of the scope of work but also knowing that we were able to continue at Hope and we we're not suffering um quite the delay costs at hope that we did at Kelly so when I talk about all of these uh pressures on the budget uh I have to start looking at what other funding sources might be out there to cover um the project budgets where it might not exist in measure HH and so three things come to mind and um perhaps I'll go from bottom and top top on the slide interest income with uh the general obligation bonds when we issue the bonds uh they go into the treasury and they do earn interest um
118you know that we're not out there to make money on that interest but while we are waiting to uh to expend the dollars on the projects there is some revenue and so that actually has provided a little bit of a cushion um because it's above and beyond the the project funds that are available for us to spend on measure HH projects so that that's a Ed us to absorb some of those increases um developer fees uh those are uh mainly smaller projects whether it's an infill type of a project uh say like the downtown Carl's bat type of projects that we're seeing uh or uh folks that are doing renovations on their home and expanding square footage uh they need to pay developer fees and uh that's intermittent it's uh very sensitive to the economy
119and also uh interest rates so whether people are remodeling or they're moving up um it it really is not that predictable when we will um see developer fee dollars come in and then we have the community facility districts and as the board is aware uh when developers move forward on a project they have a decision to make and it is the the developer's decision that is will they pay the developer fees to mitigate the impacts on School uh by by growth uh in in residential developments or will they choose to form or Annex into a community facility district and pass that cost on to the folks that purchase the home and so we do have five Community facility districts in the district and they are generating some revenue and so we'll talk about that and
120the possibilities that we have there um coming up thought I would give a quick reminder of the projects by phase uh phase one uh as we we are starting to to wind down um phase two as the board knows we expanded that uh to take advantage of the uh very low interest rates um by bringing more phase five dollars forward and uh therefore pulling some phase three projects forward including at uh Aviara Oaks Middle School CVA Pacific Rim and doing the design phase of the cultural arts center so additional projects th those are a sort of a phase two B uh phase 2A is currently in that uh design work and again we'll be talking about two of those projects tonight uh they will be following shortly with um with the other projects in phase
121two this is an update on uh a timeline that the board has uh seen before uh just updated with the bond series uh B and the increased amount um but the timeline really stays the same in terms of the uh design and construction for each one of those phases um when when we added the additional $30 million to series B essentially We Shrunk the size of uh series D pulled that forward okay so let's look at at budget history and uh this is a walk through time the we have the 2018 estimate for the uh five phases and this was how the bond measure was sized and as I look at my predecessor's notes from uh about a year ago uh he was recognizing uh about an 11 million um uh increase uh from that
1222018 uh estimate and then as I look at where we stand right now you that's gone up again and of course that is because we're getting more information on uh the increases with Kelly and and hope I've also um added to the these estimates um we'll be talking about buav Vista a little bit later and and we're over the initial project Budget on that um with what we're looking at right now so you can see the change from 2018 to now the the big one in phase two again is because we chose to pull projects forward uh but we have about a $15 million gap just looking now and and I will say the phase three four and five uh projects and some of the phase two are still at those original budget uh estimates
123that that we established in 2018 meaning we want to stay within those initial budgets oops went too fast there sorry about that so all of the measure HH projects uh uh project funds have been obligated uh the um we we have series A and B uh and those have been obligated towards phase one and the revised phase two uh we do have other Capital funds that can be applied towards these Bond projects to offset those cost pressures and so walking you through the the table on the right um You have the the initial amount that was authorized of of 265 million we have issued just under 178 million we anticipate interest earnings we have the costs of issuance so you pull that out of the amount that was uh that was received in the um
124in the bond issuances and so our net project funds uh just under $180 million when I add up right where we are right now on phases one and two uh we're at a little over one 181 million so there's a there's there's a gap in phase one and two uh of that just under $2 million as it stands right now um so when I when I and that really that's 1% uh when when you look at it so well it's a lot of dollars it's it's um not that insurmountable of a of a margin however uh it is in excess of the original budgets on those projects so it it essentially could pull from say phase five projects which were always the ones that we looked at we would do you know should we uh
125still have remain funds the place where I would look at immediately uh to cover cost overruns would be down uh below with the estimated balances and either our our cfd funds or our developer funds and again I'm showing the $83 that we have in the state school building fund uh just as a reminder that we don't have dollars from the state building fund uh we received them in the past um we have less than $100 sitting in that fund we've applied for uh for modernization dollars in the current state building fund but we are are pretty far down the list to receive that uh to receive any funding so at this point I I will assume we will not get it until we get it until I have a funding letter um that says we
126have been issued um that that's that's when we'll make use of those dollars but right now we can't really anticipate it and when I use words like million rather than giving you an exact and precise number just know that these are estimates and really estimates based off of the end of the end of this fiscal year um that's my way of of saying it's not exactly in the bank but that's our projection uh for where we'll be at the end of this year so let me talk a little bit about the community facilities districts as I mentioned uh we have four of them and uh they some of them have a little bit unique qualities um cfd1 uh which was our original one uh it is uh uh it is very well established and it
127was uh funded um primarily for the Aviara attendance area and um and that one is winding down um we can see the light at the end of the tunnel um when when the special tax was authorized um by the developer voting to impose that uh it it runs for a period of 30 years and so we're we're starting to see that cfd wind down and uh and I'll talk about that in a moment uh and we're not annexing any new properties into into cftd number one cftd number three uh is spread out in a number of places throughout the district we previously did Annex um properties into cfd 3 uh in the past in the in the 9s the the district issued what are called certificates of participation and we used the revenue from cfd
1283 U to pay for the that that Capital borrowing that we did in the 9s and it's been refinanced a number of times to help save on interest costs U but those are going to run until 2036 so while we were receiving substantial Revenue in cf3 uh almost all of it is obligated towards paying that debt service right now um cf4 is is a very small one it was one development and uh not much revenue coming in and that one wind down eventually and then we have cf5 and cf5 uh while it's primarily in the northern part of the district there are some developments that have been annexed into it in the southern part of the district and uh as developers come to us uh and an opt to be annexed into a cfd rather
129than paying developer fees up front uh they are we are currently annexing into cfd 5 so um that one is younger and it's growing and as I I already mentioned uh fund 25 developer fees and and where that comes from so let me talk here uh about some of the dollars that we're seeing coming into to the cfds uh 13 four and five uh and I'll walk you through and and I and this this chart has changed to slightly um when the cfds formed the uh developer not only uh authorizes uh allows the cfd to be formed um but also grants the authority to issue bonds against the for the future revenue of the cfd and that amount is stated in the formation documents and so for example uh when cfd1 was formed the developer
130said uh you may uh impose the special tax on the development and you have the authority to issue up to $14 million worth of bonds um we did Issue debt and we have no remaining bonding capacity so the authority is how much we're permitted to borrow under that formation document the capacity is how much revenue is remaining that we could borrow against uh to issue bonds uh we still have uh just under $1.5 million uh worth of debt outstanding and uh we're receiving as you can see $16,000 a year to pay off that uh to pay off that debt service but we do have a fund balance so that we have earned a bit more than we owe and so we do have $1.2 million uh or will expect to by the end of this
131year um those and and and essentially this works the same way as I as I walk you through um and and just know that bonding Authority doesn't mean that we can just run out and you you look at the 175 million that was set on cfd 3 back in the 90s um just because we have that permission doesn't mean we have the future Revenue to pay for it because we've been collecting against that uh that cfd uh for many years and we have existing debt that is already secured by the revenue coming in so I don't know what that number is but it's not 175 million that we would be able to um legally and Incredibly borrow against but we do have a fund balance there 5.6 million and it is growing uh our annual
132revenue is 4.5 million but our debt service is about 3.8 million running through 2036 so we get about $700,000 more a year that continues to go into that fund balance and um and so on cf5 uh again that's a younger one uh We've not issued any debt against it we have authority to issue up to 60 million um but I've not gone through the exercise with our consultants and our financial advisor yet yet to determine when I look out over the future of how long residents in cf5 will be paying the special tax and at what rates you how much revenue will we bring in over the life of the cfd that we could borrow now so why would we borrow now um the funds in the community facilities District they're meant to mitigate the
133impacts of the residential development on the school district district and so uh generally the uh funds in the cfd can be used for uh any of the schools that are served by the students who reside in the cfd some cfd documents will often have very restrictive language others it's about as basic as I just explained it uh I already mentioned the bonding Authority is built into the formation documents that would permit us to issue bonds U but again the capacity really is built upon how much future Revenue uh will we receive by the current uh payers of the special taxes um over what period of time tells you your future Revenue therefore how much could you borrow against and recognizing that you do have to cover both the principal and the interest why would you
134borrow this now as opposed to just accepting the annual revenue and and building that up over time remember this is a decision the developer makes uh to rather rather than paying the developer fee up front they're saying it's going to be paid over time but the kid show up now and the impacts are now and so um if if we were to just drop all of the cftd dollars and and let it sit in the bank and then once we've amassed it all say okay now let's do a project to mitigate against this growth the students who were originally um residing in the cfd might be parents themselves of students who are living in that cfd because it takes 30 years to get there so this is a reason why districts often will borrow uh
135up front against that and let me point out that issuing bonds secured by the cfd does not increase the special tax that is already set it's uh when when folks purchase their homes and they find out they are in a community facility District um that special taxes disclosed to them uh and and that again is set so issuing the bonds doesn't then impose a new tax it is just um it is just Revenue that is the revenue that will pay off the debt service for any bonds that we could potentially issue so uh I've said quite a bit here uh but what what I haven't said is how much could we conceivably borrow and again the answer is I don't know yet uh what I wanted to do this evening is introduce this uh concept
136and one talk about the funds that we currently have on on hand the that we expect to have about $10 million in cfd dolls and would we want to apply that to measure HH projects um to help stretch those dollars further for costs that were unforeseen back in 2018 whether that was uh inflation pandemic related uh or soft costs that were not foreseen um and do we want to explore what the capacity would be to issue bonds across all uh all four of those cfds but probably uh really only looking at cfd 5 as the one that has the most room uh to bond against as the youngest one and the one that's growing so the the funding Alternatives one you know I do want to assure the board and uh anyone else that's watching
137uh you know that first things first you we're looking to contain project budgets whenever we can and that's not to you know unfairly eliminate things um but really to focus on what the priorities are and also make sure that we're making the best and most efficient uh decisions on how to go about the renovations that we've proposed um so we are always constantly even if we we're not having this cost pressure we would be looking at ways to make sure that we're setting realistic project budgets and then sticking to it once we we move forward with construction as phase one starts to wrap up uh you we'll be looking at those contingency budgets and and pulling out any of the unspent dollars in the contingency and those you know drop back into the available project
138funds for measure HH you know the contingency budget is there just in case the real project budget is below the contingency budget so uh it's good news when you haven't expended uh the entire project budget including all of the contingencies so um so it's always good news at the end of the project when you can release the contingencies back because that you were able to stay within budget uh the the hard and soft construction budget um recall again you know phase five projects you know those were discussed back in 2018 at least in documents that I can see um that those would be you know lower priority remaining projects should we have the funding and you know while we're not ready to have a discussion tonight about phase five projects and do we start rep
139prioritizing it um that is another option is to start looking at you know do we want want to um put more priority on the phase uh two and three projects and less priority on five and that would uh we would then be able to reallocate those budgets um to earlier projects and then I also say that that when we are working with our design and construction teams you know we're also looking at are the things that we are doing triggering some of those unbudgeted costs such as path of travel issues or the more hard surfaces we put in does that mean we have to build bigger and better storm water mitigation which again has to be done first before we can or at least approved of first before we can do the rest of the
140work um so we're looking at you know ways to you know um permissibly you know avoid doing work that would that would result in having to do the the um additional unbudgeted work so uh you know I already mentioned on the right side of the slide you know this is really the um the concept that I wanted to bring to the board's attention of ways that we could potentially bring in additional funding um I talked a lot about cfds and and how we could use those I didn't really talk about developer fees again it's a smaller balance that we have the revenue is somewhat unpredictable and so you know my recommendation would be let's Reserve that for future projects that we don't know about that could be related to growth and and you know that
141would be um you know dollars that we could look to for for other projects that are outside of measure HH I think I'm ready to stop talking here um and start answering questions um again this these were the next steps uh for us we'll get to buav Vista and Jefferson uh after we conclude with this item um but this ends the um the portion of my monthly Bond update and I'm happy to entertain any questions that the board may have thank you Mr Dill uh you have some questions uh starting with trusty Williamson thank you for that presentation and thank you for taking the time with me Mr Dill um earlier this week to discuss this I guess my question to you is on so it would be slide 16 I think what you're asking
142for our approval for you to pursue looking at bonding cfd 5 is that am I reading you correctly yeah I I think you know and I've only looked at uh a lot of this on paper and I've had discussions with our financial advisor um you know I and just in my my big picture o uh view of this I think that's where we have room um because we have more future Revenue coming in on that than we do with our older cfds and so I don't know how much revenue is is uh in the future for that one and if it reaches all of that 60 million I don't know so I think what I would would would like to do if this is an idea that the board is comfortable with is continue to
143have the discussion with Mr cardi and and also our cons our cfd Consultants at wan to start to build what a funding profile could look like and what we could reasonably Bond against and then I would come back to the board and say okay we've looked at it and here's how much we could um potentially borrow against and then apply towards mesure HH projects and that would lead into another discussion can I ask a followup to that uh any other trustees I have all four trustees with their hands up and and I anybody if follow up to trusty Williamson's question if not I'll let her follow up and then move to the next trusty go ahead trusty Williamson thank you is that something that we would be wanting to do in phase two or is
144that down the road when we basically run out of the funds for that um from the general obligation bond for that phase so uh you know when I look at the amount that we've issued and the projects that are currently underway under the current budgets I'm not too concerned about phases one and two right now however what we can do is uh is look at the cfd dollars and apply those to the projects that are currently underway in phase two and that will free up measure HH doll and so you know that will create you know more Breathing Room uh as as it as it were um you know for these additional costs that I know that we're going to see that we didn't consider in 2018 that'll that'll give us more breathing room in
145the measure HH funds which would be more flexible for all of the projects that we have so I would look to you know potentially do this sooner rather than later um but it might be we we think about the timing of it of of when exactly do we want to do it um and in the meantime we would be continuing to to um receive the special tax revenue and it would be just going into the fund balances thank you and my follow up to that was in relation to timing are there advantages that you know we could see based on the current bond market and that like what we did with phase two where we increased that capacity based on and what you're seeing in the market and preliminary discussions with Mr cardi yeah that
146and and that's also what got me thinking about doing this is that um you know it's it's a very good time to to borrow right now um with such low interest rates and if we borrowed now I really doubt we'd ever be refinancing those Bonds in the future I think we'd get about as good as a deal as we possibly could thank you uh trustee Pearson thank you uh Mr D I know you mentioned about State modernization funds uh do you have a status on state matching funds or is that the same that's essentially the same so um yeah okay thanks trusty Rawlings thank you and thank you for the presentation um back in uh 2015 16 uh we spec we as a board specifically changed the attendance boundaries for um hope um under cfd
147number five um the students that were coming out of Corey Creek um were originally slated to go to Buena Vista and uh we made special arrangements with the developers to bring them into hope um so in that case would we specifically be providing dollars out of cfd number five let's say to offset some of the costs at Hope or to utilize uh those dollars specific to attendance boundaries we yeah we could do that uh and and I am aware of of what happened there I I spoke with M oconnell uh specifically about that um and so I'm aware of of of of that restriction the way that the language is worded is that it doesn't say hope in the agreement it says the um the schools that serve the students who reside in the cfd
148currently that's hope um but it is uh also um I believe it's ch or is that looking at the map right now it's also the middle school and it's also the high school so you know the it's not just the Elementry School that serves that the that development we've got we're a K12 District so we could look at the we could look at that or CSA serve students in the entire District so you know we could we could you know take that view of the CF of that cfd and we would just have to make sure that we do apportion that correctly um you know for those projects thank you trusty Williams followup uh is there is your question related to that question trusty Williams okay go ahead trusty Rawlings um and as a followup
149um then would there be um you would not be coming to this board asking for any attendance adjustments or attendant boundaries in order to tap into any of these funds I I would certainly not be doing that for financial reasons uh if we ever do that it will be for capacity and enrollment issues it will never be uh because we want to use dollars at a different school thank you trusty Williams thank you I know you mentioned you didn't want to look at developer fees is there an exper expiration date or anything with the developer fees uh no so you know we we take those in and you know we use them to mitigate uh and th those are slightly more restricted because they really while the cfd dollars can be used not only for
150construction they can also be used for renovation um whereas developer fees are are meant to be used to for growth type of projects so I look at uh one one thing that comes to mind with developer fees is um trans transitional kindergarten uh if we are are looking to add an additional grade level um or expand the the uh number of students who can attend transitional kindergarten we will need facilities for that that's enrollment growth and it's and it's served by all the people that pay developer fees so I that's that's the back of my head where we might need to okay so I had a um I had a question for you just on procedure Mr D I heard during discussion and because I want to make sure that you get what you need
151from the board that you need do you need consensus for the use of CSD cfds to cover this Gap and then the second one was consensus to explore bonding capacity in our cfds those are the two things you're looking for consensus from the board tonight you know I um I would say at this point I don't need to use uh uh the cfd dollars to cover the Gap because we've got measure HH funds right now on hand to do that um I think I would come back to the board in the future and say okay here's where we've got some cost pressures on some of the phase two projects and I would like to pull the fund balances to cover that excess cost and I'll do that at Future meetings when we talk about budget
152um and do that I think what I would like and maybe this is a thumbs um do we want to explore the concept of issuing bonds against our future cfd Revenue uh and you know give me the permission to work with um give me the permission to work with our financial advisers and consultants and bring back a a plan or proposal if it's feasible okay thank you for that clarification trustee Rawlings um then to clarify from my last question um after you stated that um so if we use the HH dollars to finish off hope for some of the overrides we're not limited under cfd number five to let's say spend it outside of the attendance area or are we to offset to to do phase two projects so you that that quy Hills is
153not the only uh development that is in cfd 5 so uh we we've also been annexing uh other developments in cf5 including some in the southern part of the district so there is some flexibility in where we can apply cf5 okay and and I would also have to look at if we if we were to do this quickly um and you know relatively quickly uh and we were to pull some dollars um out of cf5 you know could we apply some or all of that towards the the current hope project or the the work that we know that we will need to do on the storm water mitigation cover that cost because it is serving The Hope project um and we'll feel good about that and and that won't um that won't hinder any more
154project uh HH project dollars thank you trusty William thank you trusty johnes um in 2020 some projects were recommended to move forward into phase two because it would be cost effective to touch a campus once would you be reviewing looking at moving phase five projects if those sites will be touched in phase two you know that's a that's a good idea I hadn't really thought about that um because we do have and we will be talking a little bit about um that and Jefferson um in a moment um about work that was considered as a ad alternate if we had available funding to pull forward and you're going to hear that that's not in there right now so you know we I could go back and as part of this continuing conversation say if we
155have these funds available um you know can we use it the the the difficulty with with Jefferson um is we have a few small developments that in that attendance area that annexed into phase 5 um so I I would have to see how much capacity would we have to move $50 into a Jefferson project thank you but we could do that with with all of them and you know perhaps there's a way to do it trusty Pearson Mr Dale thanks for all the detail what I was going to ask you was a few moments ago you talked about borrowing against uh future cftd Revenue correct and so I had a question that we if we um if we agreed to support that concept um would you come back also with a risk analysis yeah so
156you know part of that would be you know it's not just the the revenue that we receive but we would then have to pay principal and interest um The Good the good news is is that cftd dollars are very stable um because the special tax has already been assessed and agreed to by the original developer and all the subsequent property owners uh and the County Treasurer will collect it and so it is a you know it's just a matter of how long will that run until it drops off and that's the analysis that you have to do um you there can be delinquencies but in this County with the Teeter plan we would we would receive all of the revenue that was that was um put onto the tax bill um and then the county
157deals with delinquencies so um you know it's it's a fairly stable and certain Revenue stream it's just a matter of how much is it great thank you thank you trusty Rings um yes um after my after our last meeting um concerning this I did a little research and I just wanted to verify that the the potential State bond is um ab75 if that's correct and then um is there a Senate bill or is that the bill that they're kind of fighting over right now yeah you know and I didn't I I had it fresh in my mind last month um there's two competing bills um one includes higher ed the other one doesn't they're reconciling the differences and there will I will say there will be an agreement on a state bond for next year
158I just don't know what the final form will be and what the what the amount will be so just to confirm there is a Senate bill as well as an assembly bill at this moment correct yeah and there and there's some minor differences between the two okay thank you thank you any other questions trustees so Mr Dill has asked for us to uh for consensus on uh having him explore bonding capacity uh in our cfds and so by show of thumbs uh can we get that consensus gathered for him or would you yes let's start there trusty Williamson again what it is that we're giving thumbs to to exploring it to exploring it go ahead Mr D yeah and and it is to explore the uh bonding capacity of our four cfds and you and
159then upon review um to bring back a plan to the trustees to consider if it is feasible we would not be expending any funds on this right uh you know I don't I don't know what our Arrangement is with our financial adviser I've I've seen it work both ways where sometimes they they do the work on spec and other times they they do fee for service I'm not sure how we how we're contracted with uh with Mr cardi but um um if it is it would be minimal your hand is up trusty Williamson um I I'll be I'll have a thumbs up as long as Mr cardi is doing this unsp because I believe that that's how we have had handled things in the past that's generally how they do it they they give you
160advice and and then if you if you decide that you wish to move forward with the financing then you know they provide all that work for their their usual fee okay thank you thank you trusty Rawlings um I just wanted to ask that um if that'll include kind of the projection of interest rates over a particular period of time um and I'm just saying I'm I'm in favor of the concept um based on the low interest rates but if we start seeing interest rates going up I'm not sure I'm as much in favor so I just want to make sure that any any exploring will be looking at that as well so you know we would lock in the interest rates at the time that we issue the bonds and and we don't do auction
161rate or any kind of variable rate financing so whatever the the rate is the morning we sell that's uh that's all known uh at the time of the sale and it won't if if suddenly we're back in the 70s and it's double digits uh it doesn't matter we we issued when it was you know 2% no what I'm saying is that as you're exploring it will that be part of the report to us what the projection of interest rates is over time over the next six months or what have you uh yeah you know they they can look into they they would know in the short term what the Outlook would be they might not know what it's going to be next year but they could be Fairly reliable on on you know the upcoming
162year thank you and so can we see a show of thumbs thank you that's five thumbs to do the exploratory work okay recommended by staff uh any other questions or discussion I guess board discussion seeing that there's no more board discussion thank you Mr dill and uh we look forward to hearing more on this and thank you for bringing it to us as an option this brings us I I wanted to take a quick five minute break if everybody is okay with that uh it's currently 8:25 we'll come back at 8:30 great we'll see you then it is now 8:30 I believe we have everyone back this brings us to item 7.3 let me just make sure I have Dr Churchill great and I see all trustees great this brings us to item 7.3 FMP
163Phase 2 modernization project final design for Jefferson Elementary School uh trustees this is a discussion action item and for this I'll turn it over to Mr D all right thank you and uh that last one was just the warm-up act because uh here we go uh so uh tonight uh you'll be reviewing the uh what we hope is the final uh uh schematic design of Jefferson Elementary um the board is previously seen presentations uh from our partners at LPA and they will be running you through uh you what we see as the final design and highlight any changes that have been made um which have not been been major since the last uh discussion um you know I'd like to point out uh as I mentioned earlier that at the last meeting there was discussion
164of pulling forward some of those phase five elements uh for precisely um the reason trusty Williams mentioned once the once the design is underway and and once the contractors are there there's some efficiency to get all of the work done at once um you know at this point we are we are up against the established project budget and so that alternate work um is currently not what you're going to see tonight if I'm if I'm correct on this um but Mr Kissle will will discuss that as as he gets into the um the presentation um but that said we have an idea of how we might potentially do that um so in in approving this design tonight what the trustees will be doing uh is to give us the go-ahead to proceed with essentially the
165construction drawings um that we would then be submitting to the division State architect and addition to um the city of of carlbad and you know any of the other public agencies that we need to work for with in order to get the approval to then go out to bid and and begin the construction so this really is the launch phase on that and when we get and and since I do mention that you know we're right up against the budget and there's some other things that you know may still be unknowns on this project when we get into this deeper design you that really is when uh all of the team comes together to review constructibility and the feasibility of um the elements of the design you to try and find efficiency wherever we can
166and if you know we get through this process and and it's it's not something we can submit to DSA or it's not something that we can fund or if there's some changes along the way we would have those discussions publicly with the trustees so that you would be aware of of any challenges that we've got um as we get deeper into the the design on that so with that I'm going to turn it over to Jim kissell who's with LPA and I'll let you introduce your colleague if if they're going to be part of the the presentation as well um Jim is going to be running the presentation so I think you've got the you've got the power to do that so I'll say take it away Jim and if you want to begin projecting
167your screen uh go right ahead okay uh thank you Mr Dill let do that can everybody see the screen um well good evening uh president Jones uh superintendent Churchill uh board members uh District staff and Community I'm very pleased to be here tonight to give you an update on the evolution of the Jeff Jefferson Elementary school modernization project um also on the phone tonight is aino uh tur bontes and he is um uh a project uh job captain on the project and is listening in tonight just to uh hear any direction that is is taking place on the project so in terms of the Jefferson Elementary School uh the agenda for this evening is just to give you an overview a quick reminder of where we were at the last board presentation when we were
168in schematic design we are currently completing the design development phase so we have a lot more information on the different scopes of work and the cost of those scopes of work um we will walk through the construction cost summary where we are at this point and also show you some at the end uh some proposed um Evolutions to the design for the stem and culinary arts spaces within the program uh this is the existing site diagram that we presented previously of the Jefferson Elementary School campus and this is the program analysis of the facility both on the left the current where there's approximately seven 37 different spaces and then on the right the phase two plan which has uh 32 spaces uh within it I do want to note that this phase two plan represents
169the master plan proposal for the campus and and includes the phase five items uh that currently aren't funded at this time so not being documented um I will show where those areas are on the plan because those phase five items are not there which is p primarily the relocation and expansion of the library uh to be more appropriately uh uh educationally sized um there are three additional State uh spaces on the school where that Library would be eventually located so at the end of phase two there would actually be 35 spaces on the campus as opposed to the 37 current uh the projected enrollment which we shared previously on the left was the projections from the facilities master plan and on the right were the current 20 uh 21 uh numbers and projections uh this
170was the scope of work that we shared at the previous board meeting uh the items that have been grayed out are all those items that were shared uh the one on the top is the one we've actually delved into a lot more deeply regarding the nine existing relocates and the addition of the monitorization of scope of those rooms uh to the program so that includes uh new Roofing Windows upgrade to LED lighting and new mechanical systems uh to refresh uh those uh portable facilities or modular building facilities and those costs are now included within our cost estimates so this is the master plan diagram for the campus with the revised spaces um the phase five is highlighted in that kind of ochre color and includes the existing Library which would become a Learning Center which
171is there by the building a label and then to the right of it Building C would become the new library and computer lab at that facility so that is the location where there are the three additional teaching stations until phase five is completed um that's a fairly isolated self-contained project so when F phase five comes along uh it can be implemented rather easily to the campus um you can see the lower left that we have labeled the uh modular buildings with the proposed uses and most of these are the current uses of those spaces um that are currently um accessed by the site and District programs uh looking at the scope of work and this is a scope of work summary that we've developed during the design development phase on the left is the base
172program and these are all the elements that were included um at the last board meeting and then added in which is the uh relocatable modernization and then on the right are items that we have discovered as we've gone deeper into design development and then some discretionary items that have come up as ideas but aren't necessarily uh required to be implemented so on the left uh in terms of the base program our budget was uh 4.9 million a little bit more than 4.9 million for construction and we are about you know $4,000 over that budget so we're basically right at the budget for the information that we have at this time for the base scope items you can see that the relocates modernization is about $1.1 million and some change uh for the the Improvement of
173those spaces for site use um in terms of the discovery items they're lumped into two categories uh the top is basically items that are being required by an agency and you heard Mr Dill refer to dsas looking more extensively at um Ada uh and path of trael travel issues and so this is actually modifications that we would need to make to the drop off and parking areas as well as path of travel lighting uh these are costs that uh in terms of our current projection we haven't designed the work but this is our estimate working with our estimator of what these items could cost and will be refined further into the process but these were would be items that would be have to be included in the project uh the second items on the list
174are actually items that were discovered during the execution of the design development phase and came up um in terms of our interactions with the site and that includes existing lunch shelter shading uh that basically the anchor bolts for the shades that come down are all coming out of the ground so all of that weather protection is not really usable um around the current lunch shelter uh relocating the bike racks to a safer area of the campus and ex expanding the trash enclosure to include space for dumpster ERS for the composting and other uh required um uh elements that of of trash and trash separation so those total about 472,000 and uh would be an addition to the current plan uh the discretionary items down down below I just wanted to mention that these are some
175ideas that have come up we haven't put in cost to those because uh those are items that um as I said are discretionary and aren't currently required for the project so looking at the Portables and and some of the other spaces um replacing the acoustic tile at the ceiling that's something that might be nice to do but isn't needed um in terms of the new fencing between the field and School uh that would be something that might come up um in terms of if there's joint use of the field and you could be talking to those Partners about how do you fund that item uh new bios swell is something that we will be looking out for as we interact on in terms of the storm water um um design with the city and site
176utilities upgrades uh currently you don't anticipate at the this at this time but that's a possibility that's kind of out there and so we wanted to highlight those but right now we haven't included them in the budget because we don't it isn't looking like these have to be issues um there any questions I think at this phase on the cost before I go to the the last slides in the presentation so I do have a question uh go ahead trusty Williams thank you I just wanted to to clarify those items in the discovery the 472,000 is not included at all in the base correct additional thank you correct trusty Rawlings um thank you um as far as the library goes on number seven I just wanted to clarify is there not going to be a
177library until phase five or are we going to kind of use one of the flex buildings as a library and a um and uh other learning spaces the library is going to remain where it is right now which is in building a it's that that that rectangle in building a that is the current Library it just isn't something that's sized appropriately or educationally laid out for what would be appropriate for an elementary school like this okay so that remains a library until if and when we get to phase five correct correct and and in Phase five the existing Library would become a learning center for housing the itinerant programs and the library would um uh go in building a and apologize the motion the motion detector went out here at at my office now that
178that's what I recall but I it that wasn't super um clear and looking at this design thank you yeah truste Williams thank you um initially going back to that the previous slide with the the map with the there you go um initially they it was stated that the reloads would be removed are any reloads being removed at all or they're just the they're they're being modernized uh none of the reloads would be removed okay thank you um could you go back to slide 8 the discovery discretionary so uh I think this question might be from Mr Dill on the uh existing Lun shelter shading the bike racks and expanding trash closure could are those considered routine restricted maintenance items or sorry I cut you off no go ahead yeah these are well I always look
179to Capital dollars first for our construction projects those are things that I look at and say you know that is maintenance of existing facilities and so we could conceivably use routine restricted maintenance dollars for those um if there's not room in the HH budget to do that thank you trusty Rawlings um I wasn't sure if it was appropriate to ask now so now that you mentioned that I'm gonna ask my question um Mr Dill um uh would any of these items or could any of these items be offset through one-time Co dollars such as some of the outdoor um spaces and those types of things and that would be true for some of the other um projects that we'll be talking about tonight that um uh where we might be able to offset some of
180these things um you know nothing really jumps out at me to say that's a that's a that's an outdoor learning space because of because of covid um you know I could always reconsider that and really the the remaining funding source that we would have would be our federal Esser $3 um because our State dollars we've obligated and we haven't developed a plan for that and I really would need to look and see what capital expenditures you could do out of Esser um it's they're they're they're quite strict on uh capital projects with the federal dollars so this is actually more flexible um our own local funds and and at the and I would also have to consider the the use of the the Esser dollars um you know could continue many of the efforts that
181we did for expanded learning opportunities this year to continue into the next year or to mitigate some of our enrollment loss if we don't rebound so I've got other operational thoughts in my head on those um but I can keep that in mind thank you uh please proceed Mr Kissle great K right or k okay great you got it uh so the the last couple slides here are just showing some evolution of the uh Steam and culinary lab spaces this is the sketch you saw uh when we last met and we've been working with the district and stakeholders to evolve this with our Interiors team so in terms of The Culinary lab uh you can see evolution of the space uh really looking at the layout of that kitchen and having it uh function appropriately
182as a teaching space um and also a student space uh roll up door to the outside which is that outdoor access to the garden and an adjacent storage room and custodial closet uh on the right are just some uh imagery of what that space could look like when complete and then the steam uh maker space uh is very similar to uh the spaces that you're seeing developed at your other campuses in terms of its layout and function and and the furniture provided and on the right you see some of the the imagery for that as as well and there is an adjacent storage room for this uh space as well uh to make it more functional lots of flexibility in terms of the organ organization of the furniture uh and also again overhead door to
183open that space to that Outdoor Learning area which is adjacent to the hard courts um on the campus in terms of our next steps uh we're continuing our meetings of our Consulting team with M staff on site to make sure that we're confirming all the utility uh issues and other on-site issues uh we're completing design development uh we're going to begin the grading permit discussions with the city and we're on schedule to submit to DSA in December 2021 and that is the conclusion of our presentation thank you um so trustees any questions for St staff trusty Williams thank you um in this previous slide slide 12 is there access between the Steam lab and The Culinary lab uh we could provide access there isn't a door currently uh we could provide access uh depending upon
184the structural uh issues within the building okay and that was just if you want if this if there's a um consensus with in the board to do that correct correct you there is Staff access between the two you can see there's a door there into the storage room which which leads to that share custodial which leads to the other room so staff can move between the spaces um we don't have a a student access between the rooms but we could explore that okay thank you trusty Pearson uh this might be for Mr Dill uh but Mr kissell you might answer as well were there any Lessons Learned From with the city of carlbad on grading at Kelly and hope that can apply to Jefferson well Mr Kissle was part of the the Kelly project um
185uh and could probably answer that but you know I I think speaking on behalf of the organization you know the lessons that we've learned is that you know we do have to anticipate anytime that we are disturbing a certain amount of soil on a site that we need to ensure that we're contemplating all of the you know for not to make a the downstream effects uh that we could have with um mitigating any further runoff and given that we have fairly old campuses that were built in decades that had you know different considerations and weren't even thinking about runoff um to bring them up to current code compliances um you know significant work that would be done and so you know the lessons learn is one we need to keep that in in consideration on
186every one of our future projects and then two where we foresee that we will be doing work that will necessitate that permit um that we design it early and have those conversations and submittals early with the city thank you thank you trusty Williams you're muted I did sorry I didn't have a question oh sorry my internet is lagging just a little bit did you go ahead trusty Williams Oh no I sorry I didn't have my question thank you trusty Rawling thank you um with the current um enrollment projections are are we looking at uh ways to potentially um I don't know maybe uh not redraw but uh look at some of the new construction uh down like near the village to uh bring students into this campus I've not been asked to do a boundary
187study uh on any of our campuses um you know typically you look at that when either your your school is is too small to be sustainable or you've got one too big to fit all of the students um and I would have to have those conversations with the superintendent on that but uh it's not been part of the conversation since I've been here so the the projections and the um going into the current projections is not doesn't meet that criteria is that what I'm hearing you say well we were projecting that there would be 378 and now we're projecting 34 yeah and and recall that um that 2021 projection um built in our lower enrollment for the the previous school year and so when they do What's called the cohort projection model where they take
188the kids and they roll them forward through the grade years you start off with a lower number and it it spits out a a lower number at the end usually and many developments were put on hold during at least the first part of the recession I'm sorry the the pandemic and and so you know it it it messed with our projections somewhat and so I'm really looking forward to our next one um which should be built on a a higher incoming number uh particularly in kindergarten and first grade um and then checking in with the developers to see where they are with their future build outs and what their schedule is because that will then inform across the entire District um where our enrollment will be so it's we've got an anomaly in the last
189one I kind of look back two years to compare um what it was like normal last year is pandemic related induced um and this next one I think will will be a good recovery projection that we should have thank you thank you trusty Pearson yeah this is actually a followup to trusty Rawlings H question um part of the process of city cross bad is going through is this is they're going through their housing element and the requirements from the state and in fact this week they had a council meeting regarding that so I've shared with Dr Churchill that we get in front of the process as it relates to capacity in our schools as they determine where they're going to actually have these developments or or projects or how they're going to um develop the
190housing plan going forward and uh we can play a pretty significant role in that process um particularly as we look at capacity in our schools so um I I did I don't think the and you can answer this Mr D I don't think any analysis includes that part of what the city is going through at this point yeah cities typically leave it to us to to determine what that impact will be um you know in looking at most of the development that I'm just seeing driving around town um most of the is multif family which tends to generate fewer students per square foot or per unit um so and particularly in the area around Jefferson that's what's going in it's Town Homes um which don't bring as many kids as a single family home so
191you know we may still have the ability to mitigate or AC I should say accommodate um the students that are coming out of these new infill projects any other questions for staff okay um so I have a motion and a second or no may I have a motion to approve the final design for Jefferson Elementary for submission to the division of State architect so move Pearson second ring thank you so motion by truste Pearson seconded by truste Rawlings or discussion trusty Williams thank you um I would like to request to see if there was um any need from the site at the site level to have an access door between the Steam lab and the kitchen culinary lab I would hate to say they needed it and we didn't at least address it we can
192we can certainly ask and you know one thing that comes to mind is that then securing the two spaces against each other that's often a difficulty with the joining you know shared classroom doors um to make sure that one one teacher or one kid can't get into a classroom they don't belong in but we can certainly ask the principal if that would be desirable and a door is an easy thing to do if as Mr kle says it's structurally uh exactly capable of doing that thank you trusty Rawlings my first question was be do we need thumbs for that or is that something that would just be done or how do we do that with the door uh Dr Churchill yeah thank you I mean I guess the question for me is how many requests
193like this are we going to get if we're going to get a series of requests and I think we probably ought to go through the process of thumbs if if it's limited to this one it sounds like Mr Dill can uh can go ahead and inquire um and uh we'll go from there okay I guess my my concern would be that it would slow things down a bit um and I just don't want that to occur and and I mean if it's minimal finances I'm fine with it I just don't um I would hate to see it slow down any of the permits and that sort of thing but otherwise something you know as as easy as the door is something that we can very quickly explore and if it's and it won't have a
194major budget impact so um with all the other uh Renovations that are being done on that space so if we if we can make it happen and the school would like it you we can we can accommodate it and I'll let you know uh that we do it but if it turns out that um that wall can't be penetrated or the school really wants to have self-contained spaces without access between I can let you know that as well okay then I I'm good with that and then I just wanted to say that um uh I really liked the process of of putting this um especially this campus together because we as a board did have um significant imp or input and we kind of mve you know we um we had lots of discussion about
195this campus and I I really like how it's looking so I'm I'm really pleased with the um uh with the outcome so far and so I'll be voting in favor of the the final design thank you trusty thank you I just have two pieces of feedback one is um I hope if staff looks or staff and then the contractor um or the um architect look about the phase five items that if you if you if it needs to be addressed to bring that up to the board um and then second I just wanted to point out that Jefferson is a unique School in that it's an IB School so students can do an intradistrict transfer um in terms of you're talking about enrollment both them trusty Rollins and Pearson so it's not just the enrollment
196numbers per the per the area um um but you're looking at the entire District so I just wanted to point that out because I know when my students my kids were at the school it was the enrollment it was very highly um uh students were coming in because it was an IB School and it was almost at I believe at 700 so you know so I just wanted to point that out that not to just to look at the enrollment of the um or the boundaries of the of the school but also you're looking at it as an IB IB School thank you thank you trusty ra uh Rawlings I'm sorry I didn't mean to keep it up trusty Williamson thank you just in response to that Miss Williams my understanding is the current this
197projections are the actual projections it's not looking at just the student students that are in the boundary area it's those that are actually in the school no matter what school they're from so so I think those are the actual numbers it's it's not just those that are in the boundary just wanted to clarify thanks for that and I just wanted to express how excited I am uh I wrote down so excited for this project but also the culinary lab piece of it um I think the focus on Health and Fitness uh and their Garden the new uh just the focus of it is such a great example of you know taking the at master plan and seeing you know opportunities in a few items that maybe don't work and then sort of reimagining a a
198to to be able to provide this incredible opportunity and I know the families there will really appreciate it so thank you uh Mr Kissle and uh Mr T turbantes uh we appreciate the work done this project and thank you Mr Dill seeing that there are no other questions or I mean sorry discussion Miss Garcia will you please call for a vote D Williams yes truste Rollings yes truste Pearson yes trusty Williamson yes truste Jones yes thank you trustees this bring us to item 7.4 uh and thank you sorry I wanted to say thank you to Mr Kissle and tantis and and Mr Dell for that um this brings us to item 7.4 FMP Phase 2 modernization project final design for Buena Vista Elementary School again trustees this is a discussion action item and for this
199I'll turn it over to Mr Dill thank you president Jones and yes we're going through the the same process that we did with the with previous uh presentation you know I will say say that we've had more changes to the buen a Vista design um than we did with the Jefferson design from the last presentation to the current one um so you know that this is in response to you know not only the the feedback that was received during the stakeholder process but also discussions with the principal and other site staff and also listening to the Board of Trustees as well and then working within the confines of that very unique uh site out at buav Vista and the available budget and so um Mr Steve Kendrick from lonus is here and he will be
200uh he he'll be driving the presentation tonight um to walk you through the changes that we've seen but we're hoping for um the same consideration at the end of this presentation that we had on the on the Jefferson and that is to give us the go-ahead um to then enter into the the construction design phase so that we can move forward with Thea the city and any other agencies that we need to work with um to get approval for this project to move forward um you know I will as as I mentioned in my earlier presentation um while we've been up against the budgets on this um you know we're we're beyond what we initially established um here at lion OAS and I'm sorry here at buav Vista um but we we've we've Incorporated you
201know as much of the primary uh priorities of that campus as could um into this project and where we are over it's where we have identified you know some of those additional elements you know such as storm water and Grading um changes and what those costs would be and so this is when we're starting to see those budgets creep for those things that we did not anticipate in 2018 again in terms of funds on hand um with series A and B bonds you know we can cover this now and um you know should we move forward with this and be able to stay within this budget it's just a matter then of of either finding savings along the way on this project or in other projects or to find additional funding that we can apply
202elsewhere to to cover gaps in measure HH that would be the consideration so um with that I will I will turn it over to Mr Kendrick and and also if uh if your associate is going to be presenting feel free to uh introduce her as well okay uh thank Mr dill and uh good evening uh president Jones trustees Dr Churchill uh let me get my screen switched over here um okay so I think the last time we presented this was uh back in March so this is a a view of the campus and excuse me for not introducing Rocky DUS scoop just use the project architect on the project and uh she'll be listening in and taking copious notes as we move through this uh so just to orient you Los Flores is to the
203top of the page which is um North and then uh the main campus entrance to the campus is with the parking lot to the South um originally we had the priorities that were set forth in the FMP and as Mr Dill uh noted we've run into some issues with the budget and things but we kept the priorities and just focused on those things that were identified as the primary priorities in our previous meetings and that was to remove the Portables and replace with new custom Portables uh improve the accessibility in the admin restroom abandon the tunnel under Los Flores and at the same time create a new midblock Crossing uh at grade for Los Flores uh developed a steam lab uh restrooms on new restrooms on the campus for the new Portables an outdoor learning
204space upgrade the playground on the upper level uh and then interiors and cadmet Tre that go with that and then a new preschool play structure and shade structure so this was the C the list that we put together from the facilities master plan and you can see the orange dots were identified as the initial uh priorities on the campus the cluster of of Portables uh noted as relos on the on this diagram there were 12 of them uh we're replacing all 12 and as you'll see in this in this next plan so this was the concept that we came up with uh to create um the building G2 would be new classrooms and the replacing the the Teachers Lounge and workroom that we're uh removing with one of the Portables the new steam lab is
205G1 and then we did six Portables on the upper level of the campus and those are the H1 H2 and H3 there are also two new restrooms buildings proposed as part of H1 and H2 that upper level of the campus also receives the new play structure and shade structure for the preschool so just a little bit closer view of that you can see the tan is the shade structure the darker brown is where the play structure would be and then create through the fencing we would create a an outdoor uh preschool play area that would those kids would be housed in building ag3 and so they'd have an outdoor play area as well one of the things uh like at the other schools that we're discovering is when these original Portables were put in there
206was no fire department access to those Portables on the upper part of the campus so we've met with the fire department um they've agreed to let us just build out a uh the fire lanane on the upper campus and then if you remember you recall uh earlier one of the concepts that we had was to create a parking lot for staff on that upper level so what this would do is that fire lane would then becomes in the future if we have funds to build that parking lot out this fire lane becomes essentially the drive aisle for the for the fire lane so these are some quick renderings that we did of the campus the top uh two views are the upper campus with the shade you can see the shade structure in the upper
207right view the lower two views uh lower left is a view of the front of the steam lab then the classroom block and The View on the lower right is looking along that new classroom block if you're familiar with the campus one of the things that we did on the campus was we flipped the lower level of Portables so that they have views out toward the ocean instead of looking at the hillside um this is a landscape concept we developed uh with our partner ground level and you can see that uh in the upper level it's created quite a quad area the uh students coming in off of Las Flores we created A New Path coming in uh we're proposing to link it up to the existing um access ramp that comes up from Building
208B to the upper level of Campus that's currently a DSA approved accessible path but um as we've seen on the other campuses dsa's taken a pretty hard look at uh accessibility and we're going to have to we're meeting with them early on to to make sure that that accessible path will work still for the upper campus and bringing kids in off of Los Flores uh We've created a a stair that's would be re really outside um Building B that would if uh you didn't need to take the ramp you could take a stair to get up to that upper campus pretty quick one of the things that we did on the hard court area to the left is we just we rotated one of the basketball courts uh to create more of a landscape buffer
209between the buildings and the hardcore area there's two light green areas actually three light green areas um that you'll see those are the new uh water quality areas that we have um we met with the city those are the sizes that we would uh need to accommodate the the runoff for the campus so we thought um we were I guess pretty fortunate because we uh it wasn't as big an impact to the budget as we thought it was going to be so that was some good news there uh also good news from the fire department the uh uh we were concerned about the lack of fire hydrants on campus there's only a fire hydrant at the very entrance to the school with the existing parking lot there are two fire hydrants across Los Flores but
210the fire department agreed that those would be adequate to serve the campus so we did not have to um have the expense of bringing new fire hydrant onto the site the view of the couple of the classrooms a typical classroom looking at the teaching wall and then and and then the opposite view of the this campus uh looking at the steam lab uh one of the things we still need to do with the uh the School site is what is this steam lab going to be how's the movable Furniture going to configure um much as you heard Mr Kissle talk about the process that they went through uh on that steam lab so we would be doing the same thing and then this is just a quick view of what the Teachers Lounge uh winds
211up being uh and then a work room because we're displacing one of the Modell that we're removing from the campus is their current uh lounge and workroom so originally our schedule was um we've it's slipped a little bit we're looking at uh design going through at the end of October uh and if we have approval tonight we can see moving forward and getting into DSA late um October uh with our submitt also going to the city of Carl at the same time we have a couple things going to Carl's bed we have our our uh obviously all the site work with the grading and the water quality but we also have the uh on-site Crossing at Los Flores which I probably should have gone over a little bit more we've already met with the city
212to go over the concept of that it's basically it's creating a big speed table probably about 10 feet wide so that it the grade raises up to roughly what would be the height of the curb on both sides of the street so that will tend to slow traffic down coming down lost floors towards a freeway as they come around the curve we're also have uh warning light that go with that as well so we've been working with the city they're um very receptive to that concept and uh that allows us to abandon the tunnel so our our budget um our initial budget overall was 7.6 million uh the revised budget that we came our revised cost that we came back with was 8.6 so that you can see is um considerably above our initial budget
213and what that includes was all the work the custom modular modular buildings and then the soft cost of about about roughly about 2.3 million uh this you'll notice we don't need any interim housing on the campus because we feel can phase the modular work um to have so that we don't need to bring in uh a temporary or interim campus we've worked with our the modular manufacturers and our Consultants to reduce the cost uh get it down as as much as we can without Without Really sacrificing any program space so right now uh our modified estimate is 6.1 million of construction cost and that includes the modular uh and with the soft cost remaining at 2.3 million uh with that modified estimate uh we keep still keep the appearance of the custom modular uh buildings
214on campus but uh we were initially looking at putting the HVAC it's in a closet uh inside the classroom with small uh condensers outside the building uh this would replace it to what you see more traditionally on the modular buildings with a big unit on the back side of it uh going with their standard uh exterior windows um and then uh looking at replacing right now we have the restrooms integrated with the two building two of the classroom buildings on the upper campus we would go with a standalone stand standard restroom building that um the modular manufacturer would provide and that that was a pretty substantial savings to do that so and with that I'll ask any questions I know we've been here pretty late so I tried to run through it pretty quick for
215you thank you Mr Kendrick uh trustees any questions for staff or the line kna team trustee Williams okay for slide I think it's seven it's they're showing the land landcape oh wait the wrong way this one correct okay so um currently I believe I um so grade four and grade five the building H1 and H2 that's new in terms of location correct the when we met with the principal um she wanted to put the the upper grades on that sort of give them make a little bit special space for them uh but also then the H3 is the preschool so we have a separate fenced area for their play area and uh access to the play structure as well okay no I think it's a great idea how would they access the the courts and
216for the basketball courts and outdoor areas they would need to come down to that mid level of Campus where the H or where the G buildings are so that the it would be the walkway on 13 yes okay and then go around yes okay thank you and that was explained to um principal jordani yes okay I just I imagined it was but I want to make sure so my question is related to the speed table um that the speed table size and height and all that that was required Mr Kendrick that was um we worked with a consultant that had has done this previously um for some schools in South San Diego County and this was a concept that that that they developed and worked with the districts uh a district in in South San
217Diego County it may have been Chula Vista um but yeah so that basically and our speed TBL is getting wider because of conditions in the street with an existing manhole that we need to make sure it's part of the speed table and not half on half off so it actually got a little bit wider but it does they've been they are good traffic calming elements to have I guess let me rephrase the question so I guess uh because we are abandoning the tunnel the the requirement is that we have to put in some form of traffic calming and but that's not specific to what it is and how we developed the height and size and all that came as a result of uh designs that we've seen but I guess what is the requirement the
218this was the district's request to put a TR a crossing at Mid Block in Los Flores uh there are we understand there are a lot of parents that Park in a church that is just around the bend sort of on the upper right of this would be on the upper right of this slide and they walk down the sidewalk on the far side of the street and then cross pick their kids across the street um without the tunnel they would need to cross at grade there or continue all the way down to pop go and go across at at at that stop sign thank you and I have a followup to that uh is your question on this item M trusty Pearson it's regarding the abandonment of the uh tunnel okay go ahead then I'll
219ask M uh if I remember abandoning the tunnel uh was that a city requirement or that was what we requested does anybody remember what the cost of that was the it was a district request and if Mr Anderson can weigh in I believe that um the cost remov from a future phase yeah that's correct the budget when when you look at the uh overall program budget you'll see $500,000 that was allocated toward the abandonment of the tunnel when the long range master plan was first developed and um when we began the schematic design for this uh project it was very evident that there were a number of deficiencies with that tunnel not the least of which was that it's not Ada compatible and so it it uh in Prior um staff reports to the board
220uh we requested permission to pull forward the stat the abandonment of the tunnel into this phase of the work uh and and certainly because we we work very closely with um Mr Kim the city's traffic engineer and our traffic Consultants uh we've come up with ways of addressing pedestrian safety uh as as implemented with a proposed midblock Crossing and so not only are we looking at you know the speed table as being a safe way of conveying pedestrians um from one side of the street to the other but also we're looking at um rapid flashing beacons that would be used as well uh and so when you consider the the curve uh on a westbound approach to this area uh you're trying to give as much advanced warning to oncoming traffic that we've got active
221use of The Pedestrian Crossing uh so what I'll say is that the um you know the Traffic Engineers have looked at this extensively they've come up with concurrence and this is the most economical way to to address you know abandoning the tunnel as well as providing a safe mid block Crossing thank you trustee Rollings thank you um the last time we talked about the tunnel and the crossing I was under the impression that you were going to uh have conversations with the city to see if there would be some cost sharing involved um did that happened and um was there any did we have any let in the cost sharing asent uh yeah thank you for the reminder we did we did uh coordinate with the city whether or not there was any um safe
222routes to schools funding that could be allocated toward this and there was not so just to be clear that we as the district will be um bearing all the costs for The Crossings and the um and the traffic aspect correct that is correct thank you trusty Williamson thank you and thank you for the presentation did I miss it or is there not a list of the costs that are associated with each of the primary authorities priorities I mean is that available somewhere uh we can we can put one together for that yes okay that it would be very helpful to always have that at these any other questions trustees okay seeing that there are no more questions uh may I have a motion to approve the final design for Bonavista Elementary for submission to the
223division of the state architect so moved Williamson thank you a second thank you uh motion by truste Williamson second by truste Rawlings board discussion okay seeing that there's no board discussion Miss will you please call for a vote trusty Williams yes trusty Rawlings yeah trusty Pearson yes trusty Williamson yes trusty Jones yes thank you uh Mr Kendrick and uh Miss DUS uh we appreciate the presentation and the work done and thank you Mr Dill this brings us to uh item 7.5 the public hearing on proposed TurnKey design and build Energy Services contract with Schneider Electric buildings America Inc pursuant to government code 4217 do10 this uh is a public hearing this is the time and place designated for the public hearing pertaining to the proposed closed Energy Services contract with Schneider Electric I declare the
224hearing is now opened I will turn it over to Mr Dill uh assistant superintendent business thank you and we did post this notice uh at the uh district office uh two weeks in advance of this meeting as is required by law um pursuant to the government code section 421 17.10 the district intends to authorize energy conservation services including but not limited to scope determination Energy savings project schedule project price for a chiller plant upgrades system programming energy use optimization permitting uh from uh the authorities that have jurisdiction on these types of projects requisite Ada upgrades and uh any other facility infrastructure upgrades as required uh related to this project thank you Mr Dill uh have any written comments been received from any person as to this proceeding Bo clerk no written comments have been received
225thank you uh has anyone registered uh to speak regarding this matter Dr Churchill no ma'am hearing that there are no comments I declare the hearing is now closed do the board members have any comments they now wish to discuss regarding this item thank you we will now move on to agenda item 7.6 resolution number 06- 2122 making findings required for Energy Services Contracting authoriz or authorizing execution of an Energy Services contract with Schneider Electric buildings of America Inc item 7.6 uh as I stated ter um this is a trustees this is a discussion action item and for this I'm going to turn it over to Mr D thank you president Jones and this is while this uh on its appearance would be a design contract because it has uh Energy Services and conservation in it
226it has its own special place in the government code and requires these findings and a resolution so it looks a little bit different but it's very similar to the type of work that that we do elsewhere throughout the district uh in terms of of a construction project um I I first want to start off and say that um you know we've had some confusion about this project and other work that's previously been authorized at carlbad high school and you know I apologize for any confusion that we've had because the terminology is very similar and and you know even I had to walk through exactly what did we approved before and what are we talking about now um because it it all seems like we're trying to cool the air um when we look at this
227so let me just uh give a a very brief explanation that um with the Carlsbad High School um science classroom upgrades and chiller plant Renovations um the board did approve replacing an element of that chiller plant called the cooling tower um as we got into evaluating the the replacement costs and the design necessary um one we we noticed that there was additional work that needed to be done and so uh with the the chilling plant which is additional systems controllers um you know water systems that are used and and a part of this came from um Schneider Electric is they were doing the solar work not achieving the savings that that we would have otherwise uh expected and it was traced to the amount of energy that we were using in the CH the current
228plant and the the controllers and systems that are there um Additionally you know we we are um also not effectively using water uh that's necessary for this plant so um so as all of this work was put on hold it was really to look more comprehensively at the full chiller plant and the overhauls that were necessary in addition to the replacement of the cooling tower which does need be done as part of this project um we still have the money budgeted for the cooling tower replacement um we could proceed with that separately and since that system is failing faster um it's just not an inefficient it's actually failing um you know we could actually move forward with that work um and replace that Tower what we're talking about here is looking at the remaining part
229of the system and making improvements so that uh we use less water and we use less uh Power to cool the water that then is circulated through three buildings to cool the building um so that's the Energy Efficiency design work that we're asking for permission to assign to Schneider Electric to design that chiller plant overhaul project as part of the Energy Efficiency projects that we foresaw with measure HH um that would lower our overall consumption um throughout the district so we would be we would be asking for them to design that and then once we have an eye on the design we can cost that out and that would be a potential future project um that we would bring forward to the board to say okay is this uh a specific Energy Efficiency project that
230we should move forward with and part of Schneider's work would be to say if you do this work this will be the anticipated savings by putting in more efficient structures and components in the system and you will have the savings over the life of the project and we would bring that forward as to say here's the cost here's the operational savings and the efficiency that we would achieve is this a viable project that we want to move forward with so this is really the the design piece which you know I would say we really need to do and if we if we don't have this NE necessarily in phase two or phase three at this point but the sooner we get the design work done we'll be ahead of the game when we make the
231decision that you know what we can't suffer these electric bills or a failure of one of these components soon we've got the designs let's move forward with the project so that's that's what we're asking for tonight thank you trustees any questions for staff okay seeing that there are no questions um may I have a motion to approve resolution 06 2122 TurnKey and build Energy Services contract with Schneider Electric buildings America's Inc as uh presented by exhibit a so moved pear second Williams thank you Williams thank you so motion by truste Pearson second by truste Williams board discussion I'd just like to say thank you for St sta for tolerating my uh due diligence to try and understand the difference and you did a wonderful job explaining the two I mean it's a complex system and
232and I'm hopeful that uh you know once we get this going that you know the system works well for it's important obviously with the planet warming up that to have functioning AC and all that for our buildings so thank you for that explanation and thank you for the work on the presentation trusty Pearson uh Mr I'll be interested to know what kind of savings we we actually get and that that would be the analysis and the design work that and and that's essentially why this contract looks different with the resolution because that's that's what we are saying is that they are going to design something that will then essentially pay for itself over a period of time so that what we're trying to do here any other board discussion trustees seeing that 's no board
233no more discussion Miss Garcia will you please call for a vote trusty Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes trustee Jones yes thank you trustees this brings us to item thank you Mr Dill uh and Mr Anderson if you're yeah you're still on the call thank you so much for your help with that item 7.7 certificated substitute salary schedule trustees this is is a discussion action item and uh for this I'll turn it over to Mr thank you good evening you recall last year in response to critical shortages of substitute teachers and Market phenomena associated with the pandemic we temporarily increased substitute rates of pay uh for the last school year those rates rolled back automatically on June 30th and in reviewing the market once again and what neighboring districts are
234compensating substitutes um it's our recommendation that we once again augment our substitute rates of pay for the coming year specifically we're recommending that our certificated General Ed substitute is paid $170 a day that's an increase of $20 over last year a general Ed substitute has paid $18 a day that's an increase of $20 over last year and that General general education long-term substitutes are paid $180 a day effective on the 11th consecutive day in addition to these rates of pay we would remain in place our loyalty bonus which pays a substitute an additional $500 once they've reached 100 days of service with our district in a given year um I wish I could tell you with confidence that these rates will keep us uh flush with Subs I I'm not certain that it will um
235we have a critical labor shortage as you're aware which has not uh not been ameliorated by the receding pandemic um and our neighbors continue to escalate the cost or the rate of pay they're paying substitutes and while I understand the market is what it is the fact is that the pool of folks that are available to substitute is relatively small and given the fact that the minimum wage continues to increase and we are now also competing for labor with fast food chains in fact one notable chain is paying $17 an hour which is the equivalent of $136 for an8 hour day um you can see that we are probably in a long-term cycle of increasing sub rates but this is our recommendation for today if we find that this is insufficient for our needs we
236will pivot and bring back an additional recommendation to you subsequently thank you Mr Grove questions for staff truste Rawlings uh Mr Grove um in the future would you uh consider looking at U more um uh temporary or permanent uh type employees uh in order to um have more um sustainability or long-term um ability to use uh those employees for uh substitute assignments yes thank you we're prepared to Pivot quickly should we find that we're unable to secure sufficient substitutes when you you talk of regular teachers when you consider that our step one range one teachers paid $236 a day plus driven cost you can see that rather than raising the rates uh higher than I recommended here we may in fact be better off hiring regular teachers under temporary contracts and assigning them to school
237sites we'll make that determination when school begins and we determine what our needs are and what uh you know how we're doing compared to neighboring districts with with respect to our fill rates thank you uh I have a quick question I I feel like I read an article about some quick emergency pivot that the legislature did to welcome back retired teachers it will that impact us or is it still in deliberation No in fact that there was an executive order uh that you're referring to that did roll back the 180 day waiting period for recent retirees that may in fact help us there are still some hoops we have to jump through to to make that work and I'm not yet certain that it applies to substitute positions it is for positions where there is
238a critical shortage but that typically is not included substitutes so I still have some research to do on that but if that's the case you can count on us reaching out to our recent retirees and asking if they're interested let me also add that while the 180-day waiting period would be waved the earnings limitation would not be and that's in the magnitude of about $48,000 a year so a stir reti can earn up to the earnings limitation approximately $48,000 a year after which there is a one for one deduction on their retirement income and when did that go into effect will that impact this coming school year is that kind of the yeah it was emergency offer it's ineffective thank you any other questions for staff trustees seeing that there are none uh may I
239have a motion um to approve the proposed certificated substitute salary schedule as presented so moved Williamson second Pearson thank you motion by truste Williamson seconded by truste Pearson board discussion seeing that there is no board discussion Miss Garcia will you please call for a vote trusty Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you Miss Garcia this brings us uh and thank you Mr Grove thank you uh this brings us to item 7.8 revision of board policies first and second reading trustees this is a discussion action item uh and I will be turning it over to um Dr Churchill but first I just uh how this item will go I wanted to um share that there will be two motions that we'll ask for for this item the
240first Mo motion is for all of the new and updated board policies and the second is for the two policies that required uh or needed a second reading and then um Dr Churchill has brought and Dr NY brought attention to board policy 6158 this is the one related to independent study that will impact uh this school year um so with that I'll turn it over to Dr Churchill thank you and I appreciate you front loading that um I'm hoping to move this along so we can get you all out of here by about 10 o'clock so like sisifus and his Rock we continue to bring board policies to be updated in compliance with uh C with um uh School boards Association uh the 10 that you see here are just that um alignment with what
241csba says we need to uh approve so Dr NY will be able to answer any questions you have and then um there are two that you've seen before as a first reading and Dr n is happy to answer questions about those as well thank you Dr Churchill any questions Trustees for staff trusty Rawlings thank you and um thank than you Dr NY for your comprehensive um uh information in answering the questions about the uh the um the discipline and suspension and expulsion um I just wanted to clarify that um is your interpretation that the discipline and suspension expulsion that's up for a second reading tonight um prioritizes restorative justice practices as this board has expressed in the past yes I believe the way the board policy is written were to explore all options including restorative
242practices and that's as a priority correct correct we would want to First Look at restorative practices there are certain mandatory uh suspendable and Expo you know expellable offenses that we don't have choice on but for the Quasi suspens able offenses as well as expellable offenses um we certainly would want to use the restorative practices whenever possible yes and it does prioritize that thank you I just wanted to get verify your interpretation of that and then I did have a question for um Dr Churchill also let me uh ask trusty Williamson to share her question I'll come back to you uh Dr and I on the two uh board policies that we're just discussing right now there was a reference to in the words something about as seen below or something like that are is that
243reference going to be removed yes it needs to um State we'll make that correction so that it it refers to the AR um uh in the in the BP that's correct and we can approve that tonight with the assumption that that change will be made correct that is correct we will definitely make that change before it goes live thank you do you need that stated in the motion Dr NY uh no you know I I think I have the intent there and it was staff air so no I don't believe we do okay thank you and so I just wanted to clarify on um board policy 6158 um is that being pulled as separate or um how is that being dealt what I wasn't clear yeah so so you have the opportunity to to to
244make a motion to approve all 10 and wave the second reading um that's one option if you thought you didn't want to wave the second reading for the other nine then then I think we need to make probably three motions a motion to approve nine as a first reading uh a motion to approve uh 6158 as a first reading wave the second reading and then the other two uh as a second reading I hope that makes sense I just wanted to be clear I thought I heard you say in the beginning that you as staff have some input or had something to say about 6158 is no we our Board needs to um approve 6158 before the school year starts uh that's as a direct result of I don't know was AB 104 AB 130
245but what one of one of the the bills that were passed this summer so we didn't have a meeting until now and we did not have two meetings before the start of school year to go through our normal process and I apologize if I didn't make that clear earlier it's my fault okay I I understand and um I do have some concerns about that one so I will bring it up in discussion um I guess before I begin asking for the motion Trustees of the nine uh other policies outside of 6158 are there any objection or are there any that we should pull from this list to make a third motion out of truste Williamson yes 6115 okay so let's start with since that's just going to be a first reading may I have a
246motion to review the board policy uh 6115 as presented and approve as a first reading trusty Williamson yeah I don't want to approve it as a first reading till we've had a discussion about it we can maybe do all the ones that we don't want to be having a discussion about but before we vote I thought we have to have a Motion in a second to have board discussion on the item H good point got it so I what I was going to do is since this was the shortest okay thank you okay so as stated may I have a motion to approve uh board policy 6115 as presented for a first reading so moved thank you and a second ring second okay so for that uh Miss Garcia it was trusty Pearson for the
247motion truste Rawlings for the second board discussion trust uh thank you I I would just would recommend that we remove the last paragraph of this item um if you want to turn to it it's for board policy 6115 I think that the way that that last paragraph It's not needed by Ed code I believe it would be an invitation to open the district up to possibly providing a platform for a plethora of additional resolutions and celebrations but while important may be better addressed elsewhere so I just think that if we and it would not preclude us from from possibly have I mean it would not change anything as far as Red Ribbon Week or or something like that but I just think that to have anyway my recommendation would be to remove that paragraph any
248other discussion trustees trusty Rawlings uh Dr Churchill um do you have any um information on what the intent of that was or why it was it was put in here and what the Education Code section States in that area uh as far as I can tell there is no reference to an ed code section um uh the process that csba goes through to update their policies um involves multiple levels of review both on the side of legal council and on the side of csba Staff sometimes items like the inclusion of this last paragraph um reflect what's happening more generally or more broadly across CBA member districts I do not believe that we lose the ability to do anything by striking the language and uh certainly staff is supportive of of uh of that if that's
249direction of the board thank you I I thought it was the second to last paragraph So it's just the last one where it says in addition correct last sentence last sentence trusty thank you trusty Rollings trusty Pearson uh to facilitate trusty Williamson's um request do we have to amend the motion no this the way I pulled it out was to have a first reading and then we've made suggestions it'll come back for a second reading so all we need for this one I believe Dr Churchill as a vote uh that is correct uh uh you're voting to approve it as a first reading staff has the feedback we need to bring it back to you with modification for the second reading okay okay uh Trust Rawlings do we need um do we need thumbs in
250order to do that in order to make that change for the second reading it would be helpful um for staff to know right now if there are thumbs for that um but uh well it would be helpful to have thumbs out okay thank you uh so thumbs for support of amending the board policy to remove the last sentence last per you have five thumbs for that okay and so since we have a motion and a second and we've had board discussion Miss Garcia will you please call for a vote trusty Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you trustees uh so then I guess of the remaining eight board policies are there any more to be pulled or amended and then are uh we still want to
251separate 61 or that would I would not be voting in favor if um it if it stays as is uh so I I would like to have the discussion on 6158 can Dr Churchill just from a process could we have that in discussion you know like go ahead and do the first wave second reading in motion and seconded as we planned and then have trust have the trustee discussion so so I would recommend at this point to just to do one motion with the other eight ask for trustees to approve that as a first reading and wave the second reading assuming that goes through then we can take 6158 on its own okay great uh so trustees may I have a motion to approve board policies uh 51 41.5 51 41.52 51 45.3 51 45.6
25251 45.7 6011 6020 and 6 112 uh and wave the second reading if so inclined so move ring thank you may I have a second um SE so seconded Williamson did that include 51 44.1 and because this is for a second reading of those uh we were going to do that as a separate so we're actually moving yep it did not include that one it did not no okay sorry then yes I definitely this is these are the board policies that we're reading for the first and waving the second got it yes and so did I have a second from yes I I okay okay so then miss Garcia it was a motion by trusty Rawling second by trusty Williamson uh board discussion seeing that there's no discussion Miss G we please call for trusty
253Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you trusties this brings us to the third of four motions so may I have a motion to approve board policy 6158 as presented to and approve as a first reading and wave as a second if so inclined so moved will thank you may I have a second second Pearson thank you so that is a motion by trusty Williamson second by trusty Pearson board discussion trusty Rawlings um I'm concerned about the second paragraph that the superintendent or design um uh what this States especially when it says a charter school that um these programs could be um uh basically farmed out to um an entity that's not part of the carlstead school district so it talks about alternative school talks about Charters
254we don't have any Charters at least it is part of our school district but um and then online course so that's my concern and I would not be voting in favor of that um as a CD board policy um if the statements remain in paragraph two so may I ask a clarifying question of Staff Dr NY is the intent of the second paragraph As truste Rawlings described or is it uh to cover the style of independent study schools that are provided by the Thousand school districts in the state of California um yeah I I'm I'm not sure what the intent the way I read that the intent is that we may provide um a variety of different options for students and that doesn't necessarily mean that we would be steering families towards Charter School options
255it would mean that you know we would we would be providing a variety options for students yeah if I can just jump into and and I you know I'm only aware of this because I've had this conversation with other superintendents the assembly Bill specifically called out the manners in which a school district could implement the independent study option and there are small school districts around the state of California that may not have the ability to offer their own independent study program so the the legislation defined specifically those options to be available to any school district in the state of California so my my understanding is that's why they're included as as Dr and I said and as trusty Jones as you as you mentioned um this is applicable anywhere across the state and and so
256the language reflects that thank you trusty Williamson did you say Williamson Williamson yes I okay sorry I just heard Williams and I thought why um my question is if it's uh if we are waving the first if we're waving the first reading and approving it as a second reading tonight does it need to be a unanimous vote so in terms of uh no not for it to be legally binding um I I can't recall whether whether or not we've had a practice like that um in the past but but no it will certainly um be adopted as a as a board policy um with three votes to even waving the first reading are you are you certain of that Dr Churchill well now that you say it that way no I'm not a 100 perc
257certain yeah I I I I'm quite confident that unless rules have changed in order to wave the first reading I believe believe it needs to be unanimous I that's trust think well no don't trust me but I did I I'm gonna look through my uh through my document really quickly here so excuse me okay while he's doing that does someone want to make an approve uh a motion that we extend the meeting Beyond 10 o'clock uh sure may I have a motion to expend uh extend the meeting Beyond 10 o'clock so moved Williamson second Williams thank you uh Miss Garcia a motion to extend the meeting by trusty Williamson seconded by truste Williams and then will you please call for a vote trusty Williams yes trusty Rings you were muted sorry I had to change
258up my headset uh yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you Tristy Jones can you repeat the the last motion for um policy 6158 yes it is may may I have a motion to approve board policy 61508 as presented approve as a first reading and wave the second reading if so inclined okay and the question we're determining now I guess trusty Rawlings do you have a question no I wanted to um uh additionally state that I don't believe we should be um uh I don't I don't believe we should be passing board policies that is meant for all these other districts um if it doesn't specifically apply to us um and uh we specifically um you know we've tried to push back on some of these you know alternative actions within
259our district and so I just don't and this isn't just for this board because it's a board policy I feel very strongly that we could change this language very easily and still implement the independent study program as this because it this language really doesn't apply to us because we can offer um these opportunities within our district thank you Dr Churchill uh how would you suggest we proceed are we waiting for the I I am I'm looking frantically to find a spot where it would definitively answer the question um uh about the ability to approve a board policy wave a second reading without a a unanimous vote can't find it right now um but I'm going to keep looking you know the the risk we run is that we start the school year without this policy
260approved and um Dr and I might be able to speak to what the possible impact of that yeah I would say my my recommendation would be either amend the language so that we can get a - Vote or uh post the language as as written uh and bring it back in September um we would we would still um try to get a 50 vote but we would just bring the board policy back to have further discussion and Wordsmith it again in December and make changes um it doesn't mean you only get one bite at the Apple at this so um either way I I our recommendation would be to post it prior to the start of school TR Williams Williamson yes sorry truste Williamson I apologize maybe my mic has slipped a little um my
261understanding is it needs to be not only unanimous but you can't make any changes to it if you wave a first reading so what what my recommendation would be Miss Rollings if you would consider it is that um we would if we could pass this unanimously tonight and and guarantee that we will bring this about back at the next board meeting and um and then we could have a discussion and I anyway that that would be my recommendation because I think the other option would be we'd almost have to hold a special board meeting in order before school starts um to not perhaps put ourselves in Jeopardy of of having some issues with not being in compliance that's my that's my hope and recommendation trustee Rollings I heard another um uh alternative which was uh
262modify the language um in order and it was and just that that one piece I'm not saying modify the whole thing it's just that piece in the second paragraph is what I heard uh Dr NY say yeah and as as I recall and I believe uh trusty Williamson is right it would the minute we modify the language it has I believe there's some uh language in our bylaws that said it has to come back for a second reading but I I could be wrong but I I think she's right I recall hearing that in the past truste Pearson here okay um so there's some unknowns right now um and I before I vote on anything I want to make sure I'm really clear on a couple points here um I think Dr NY presented an
263option about bringing this all back to uh the September meeting um I mean I if we have to do something tonight it's if I just need to be clear we have to do something tonight even though we don't aren't clear about process and we're not clear about what we can do and what we can't do in terms of votes so is it is it Dr Churchill your your point we have to do something tonight or can we can we wait till September when we have definitive on some of the points that have been brought up yes the the we we need to um have an approved updated board by bylaw 6158 this evening um or or or come back prior to the first day of school um so I'm supportive of Dr ny's recommendation that
264uh we approve Pro it as written tonight we assure you um that we will bring it back uh in its current form at the September meeting and and then you can have a a a more Rich debate and and potentially make adjustments to it then so in board policy 9310 uh. five the superintendent or design shall develop and present a draft policy for a first reading at a public board meeting at its second reading the board may take action on the proposed policy a separate sentence the board May wave the second reading or may require an additional reading if necessary the next sentence is only policies formally adopted by a majority vote of the board shall constitute official board policy uh the district's policy development process may be revised so it goes on but uh
265it doesn't say unanimous in 9310 and I'm checking the a the administrative regulations yeah you'd read faster than I had trusty Jones the ARs are silent I think the question was can you wave a second reading without unanimous is that what because I heard what I heard you say is is that you could pass the first reading without unanimous correct it says only policies for formally adopted by a majority of the of the uh majority vote of the board shall constitute official board policy okay and so I guess the the recommendation then I just want to make sure I understand where we're at then uh do we continue with the motion that's standing on the floor and Miss Garcia could you please read it back to us approve board policy 6158 as presented to approve
266as a first reading and wave as second reading if so inclined okay trustees uh let's call for a vote unless there's additional board discussion just to be clear this will be brought back in September correct if we approve this well we need we need consensus for that we need consensus for that correct thank okay so once we go through the votes it's going to come back about or request to get consensus to bring so I just want to make sure just for process this is board discussion are you asking your fellow board members or would you like to uh ask a question of Staff Trust Williams I know I'm trying to think of what if do I have cons so but it's your as president you would have to ask consensus to the board I
267just want to make sure how to vote for this yes if in the if in the next item uh because it's still within item 7.8 if there's consensus to bring this item back this board policy then we can do it then but the motion on the floor is as Miss Garcia stated uh and I have a trustee with a hand up for more board discussion so okay Dr Churchill has his hand up yeah just just for clarification as soon as you vote and take action the item's over you can't discuss it anymore so if you want to get consensus on something you need to do it now okay and we can do that in board discussion okay and trusty Williamson so if we take a vote now and it's passes 41 or 32 we do
268not discuss it again it passes but we have we run the risk of perhaps having it not be what two of our one or two of our board members would like it to be and and we would have the opportunity and in September to maybe have it be that we would all support it but if it if it passes unanimously then I am committed to making sure that it comes to us again in September if it does not pass unanimously tonight then I would not make that commitment I would be it would be a done deal and I would not be willing to bring it back up that at least personally that's how I would feel and as board president I concur so may I have consensus uh to bring back board policy 6158 uh
269for future revision is that is that yeah to the next board meeting to September's board meeting we will add this to the agenda do have consensus for that you're saying if it passes unanimously tonight is that what you're saying okay if it passes unanimously tonight bring it back to September for a revision or or for discussion for discussion yeah and that way we don't have to hold a special meeting between now and next Tuesday exactly correct and I just have a point uh trusty Williams if it's not passed then the district is not compliant is that correct no that's correct okay I have three uh truste Rawlings give your hand up um I just wanted to clarify that um when we say it'll be put on the agenda um for next um uh for the
270next agenda then we would we would have a discussion on just that item or we could we could look at it um as a whole or I'm I'm unclear why we're bringing it back just so we can get the unanimous vote that was the request As I understood it that you would that there there may not be a 5 vote if uh there was no amendment in the future I see okay okay so you haveb Williams sorry I just wanted to I don't yet we're still in discussion so trusty Rollins it would come back so we can make a modification since we can't make a modification waving the second reading okay very good that was what I was that's I want to make sure make we make that modification but we need to pass it
271if not the district will be in compliant I see okay so Dr Churchill or Dr NY could you read could you uh describe what the consensus is that I'm calling for like read it so that we so that we're all clear the final consensus that I'm calling for for staff uh I don't know that I'm clear but let me tell you what I wrote down I wrote down that you're asking for consensus that if the a motion on the floor passes unanimously tonight then at the September meeting will agenda uh 6158 again for your discussion as a first reading is everybody show thumbs that that they agree that this is what we're asking for I see no hands so okay trusty Williamson so just to clarify you said that it would be agendized for a
272first reading well well so so so technically speaking speaking uh it would never mind I got it yeah it would yeah okay and so I had 41 consensus on that and then trusty Pearson so okay and then discussion trusty Williams the only modification I would your you your request is not a unanimous decision because I have a feeling we're going to be 4 to one and you just stated if it's only if it's unanimous then it will not come back on September so I would say if it passes to bring it back in September I just saw four thumbs right we don't have unanimous decision right now you don't need one no this was actually on consensus to add the item to September's agenda correct you stated unanimous no policy okay gotcha okay okay so
273Dr Churchill just so that we're all clear and for the record please State what you have 41 consensus for all right the board just uh uh gave consensus that um if the motion that's currently on the floor passes unanimously so in a moment you're going to call for a vote if if that vote is five to zero then staff will bring this back at for further discussion in September thank you trusty Rawlings I hate to go round and round about this but I'm gon to ask one more question from Dr Churchill um just to be clear any board member could request any policy come be put on an agenda for discussion and potential Amendment correct so the difference is that um there there's somewhere in our board bylaw that if we've taken action on an
274item then then you cannot request that the same item be brought back um you know so if for example you didn't like the way some vote turned out uh you don't have the ability to say okay well then I want that to be on the next agenda again so I see so so that's why it's important now that we're being clear about okay very good okay thank you okay so now we are at the motion uh so we have a motion in a second on the floor for board policy 61 58 any further board discussion okay seeing that there's none Miss Garcia we please call for a vote trusty Williams yes trusty Rawlings yes trusty Pearson yes trusty Williamson yes trusty Jones yes for the remaining thank you Miss Garcia for the remaining uh policy
275uh may I have a motion to approve the board policies as presented and approved as a second reading this is in relation to board board policy 5144 and board policy 5144 point1 may I have a motion so moved thank you may have a second second second rings I heard trusty Pearson so uh Miss G it's motion by trusty Williamson second by trusty Pearson board discussion seeing that there's no discussion Miss Garcia we please call for a vote trusty Williams yes trusty Rollins yes trusty Pearson yes trusty Williamson yes trusty Jones yes thank you everyone I appreciate your patience on that item this brings us to item number eight governance team requests and reports are there any governance its team reports are there any requests I have one request uh to follow up on a request
276by staff so that we have it on record staff is requested that we hold a facilities Workshop to discuss uh the uh prop HH projects um staff requested either September 22nd or September 29th I just wanted to confirm the date that works for trustees both are fine with me uh trusty Jones Thank You trusty Williamson both are fine with me thank you still checking uh both are fine for me that leaves you trusty Williams sorry I have flights on both days after so um both are fine right now okay trusty Williamson your hand is up okay and then uh Dr Churchill do you need us to pick one since both work or do you want to just say no thank you for the flexibility and uh staff will go back and take a look at
