001[Music] good evening and welcome to the regular board meeting of the Carpenteria Unified School District board uh we are beginning tonight uh let's see here it is August 27th uh 5:30 p.m and we are going to begin with a roll call please all right Aon here Sally here Jamie here and I am here and Erin Eric's not here Eric's not here Eric bridgeford is absent today okay um if everybody could please rise for the flag salute ready begin I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all okay we got some sensitive mics tonight I think our volume might need to get turned down in here a little bit it's very loud yeah I

003the minutes from August 13th 2024 no questions okay um so the way we operate our meetings is uh when it's time for public comment we will let you know you just have to step up to the podium um and line up uh in order as you as you get there and you are welcome to make your public comment so at this time if you'd like to make public comment for approval of the minutes from August 13th please step up to the podium and do so now and please remember to turn on the mic so the green light is showing thank you okay I'll begin uh as you know I serve as the employee union president as usual my comments are made on behalf of District faculty and support staff who elected myself and the members

004of the employee union leadership team to share their interests their experiences their questions and their concerns uh let the minutes show that at the August 13th board meeting Union leadership commented on the district's obligation to implement a workplace violence prevention plan uh as per California Senate Bill 553 the component parts of this safety plan were required to be in place by July 1 2024 uh and uh in one week that will be two months after the state's deadline for full implementation let the minutes show that the California Senate Bill 553 requires the district to implement the following safety practices management will work and allow authorized employee representatives to identify evaluate and determine corrective measures to prevent workplace violence management will participate in monthly meetings with authorized employee Representatives that would be myself and the team

005I work with management will discuss evaluate and correct workplace related concerns and Hazards management will work with and allow authorized employee representatives to design and Implement training let the minutes show that none of these management obligations occurred during the Hasty development of the district's plan or since it has or since it was uh I'm sorry since it was hastily approved uh in June but superintendent rby said uh that it had happened and even included these obligations in the district's workplace violence prevention plan recognizing that it was a responsibility as if putting this into writing satisfies the district's obligations so yet another District plan which is completely untethered to the reality of what's happening on the ground let the minutes show that the CD has has had approximately a year to prepare to meet their safety

006obligations let the minutes show that they didn't even begin to resolve the obligation until just 3 weeks before the July 1st deadline let the minutes show that although the district both introduced and approved this safety plan without any serious board inquiry or conversation the majority of promises and obligations contained in the plan remain unsupported by the actual physical conditions on District school sites and Facilities let the minutes show that elected employee Representatives reaffirm our commitment and in to com to collaborate and inform the district safety protocols with the experience and insights of District personnel as we attempted to do at the last board meeting the board meeting before that and each of the board meetings and actually bargaining sessions throughout the 23 24 school year um but we're clearly talking to an administrative wall at

007this point and the school board seems as your is upk you if anybody else would like to speak on the approval of the minutes of the meeting from August 13th please step up to the podium now okay seeing none uh may I get a motion to approve I'll move to approve I'll second any discussion from the board okay all in favor I I I okay we're moving on to B3 approval of the agenda and consent agenda any questions from the board okay um we are now going to take public comment on approval of the agenda and consent agenda please feel free to step up to the podium at this time all righty so not so it's not to rain on your parade this evening we'll ignore the district's consistent misuse of the consent agenda to

008advance public Business Without transparency which is and remains a clear Brown act violation um we ask that you please support items six s and nine Extended Learning enhancements go a long way to supporting students and families swimming is a life skill and one of our one our elementary and secondary students need to learn and the district is required to directly support students with Orthopedic impairments items number two three and four because so many sped Personnel have left the district in the last eight months that is special education Personnel in the last 8 months cusd must still and again pay extraordinary amounts of money to backfill sped services that the district can no longer provide with the current staff and faculty in our in our midst the anticipated cost of these expensive contractors will range from

009$842,000 to 1,137 ,000 how many full-time sped teachers could cusd have purchased with 1,137 th000 instead of driving talented sped teachers and staff away why is cusd more comfortable hiring contractors to do the work yes we paid about the same in the year 23 24 but last year we had to bring on a new sped director in September who then fled the district in March as did no less than 12 special education teachers and many special education instructional AIDs that this year's costs are predicted to be similar to last year's cost is a big red flag to the community that even District leadership anticipates continued administrative dysfunction in the sped program heck we have already had our first sped teacher resign on the second day of school and these are quotes from that sped teacher

010I that's being Miss Garcia did not feel supported I have been a special education teacher for 30 years and the way this District runs their special education program is the worst I have experienced item 16 once again the district seeks approval for the regular payroll for total certificated and classified employees as teachers and support staff however the district again fails to include payroll costs for administrative Personnel why is that why is the district failing to include or itemize the following Miss rig's over $210,000 salary or School site principles and maintenance directors approximately $140,000 salaries or District VPS who are receiving over $130,000 each while for example CMS is on its fourth VP in five years do these figures include Miss Thomas's $100,000 than your time is up thank you if anybody else would like to

011comment on the approval of the agenda and consent agenda now is the time to step up to the podium okay seeing none may I get a motion to approve I move to approve the agenda and the consent agenda all second uh discussion um I just would like to point out that uh a lot of these are not well several that were actually spoken about um one is to help train staff on how to use uh AAC devices so that's specialized training that needs to come from a specialist um we have physical therapy that is needed for a student that needs physical therapy that's not what we as a district do on our own we are teachers not physical therapists so we are hiring that out to a professional and we are uh we are changing

012out our a ba uh company because this is what we were directed by our our staff that this is a better we need a better uh company to work with I'm just want to yes the clarification is none of these contracts reflect any hiring of special ed teachers these are special education Specialists that um all districts are seeking their services and it's very common that districts contract for physical therapy and for ABA Psychological Services okay thank you yep um okay uh roll roll call yeah Aon I Sally I Jamie I I'm I wonderful okay moving on to D public interest reports and presentations we have carpentera high school's FFA Future Farmers of America here tonight we have uh principal herard Coro and our FFA teacher Emily Garcia along with students so please Mr Coro good

013evening um I would like to take this opportunity to um thank Miss Garcia for doing an awesome job over the summer uh she handled the job very well and with the support of our a Boosters and students the program was very successful in the summer and that's what why we're here tonight we want to make sure that you learn the community learns about a wonderful program we have at Carpenter high school our FFA uh Future Farmers of America that I think Mr schaer was one uh I was one at at the high school and it is a great program it provides a lot of leadership skills it provides uh opportunity for students to become very knowledgeable of the talents that they have and you'll hear them today some of them would probably would have told

014you when they were freshmen that they would never be able to come to a Podium like this and do a presentation and I'm always very proud of how our students grow over the four years and how successful they become as they become leaders on campus you'll have you have one of our students who will be the student representative at this board in a couple of weeks uh you have students that are involved not just in FFA but in sports and many programs at Carpenter high school so I really want to take this opportunity to uh Rec recognize The Talented 10 young men and women that are behind me uh who will be showcasing with you tonight what they did in the summer what uh what they learned and how FFA has made them the person

015that they are today but that is not for me to tell you more uh I would like to invite miss Emily Garcia our FFA advisor and agriculture teacher at Carpenter high school hi um obviously I'm Emily Garcia um with me today I brought my minus one he's sick but my officer team for this year and I brought a couple students who actually raised animals along with some actually all my officers this year um so first and foremost I do want to recognize all of my officers if you don't mind we'll go in order from y on your up um hello my name is Yan Garcia and I'm the chapter president of the carpenter FFA this year and I'm also the Ventura section vice president and over the summer I raised a goat for the Ventura

016County Fair and I also raised ducks to celex hi uh my name is Angel panada I the chapter vice president um and I am the also the south coast region treasur uh this summer I did not have the chance to raise an animal uh but I did get to see all these students grow and um a lot of these students went to their third year and second year into raising animals and I saw each of them grow throughout the summer hi my name is Penny rot and I am the current chapter secretary and I also raised a goat this summer uh for the fair and I also raise uh breeding goats and breeding bunnies hi I'm Taylor Trembley and I'm this year's treasure and over the summer I raised it goat and I won grand

017champion she won Supreme grand champion and FFA showman and master showman don't short yourself hello my name is leani bar and I am this year's 2024 2025 um chapter reporter and I this is my second year raising a market pck for the vent County Affair hi my name is Miguel and I am your 2024 2025 chapter parliamentarian um this was my second year raising a market Pig unfortunately this year my pig did not make weights but me and Garcia are trying to figure out like what to do with her so far but yeah hello my name is Addison Hardy I am the 2024 2025 chapter history historian I'm also the um Venta section reporter um and this was my first ever year raising a market L for the Venta County Fair and I sold her

018at auction I also wanted to talk about Jacob MOA who's not here today he unfortunately is sick he's our chapter Sentinel um and this was his second year raising a goat and he sold at the Venta County Fair on top of that though I do want to show other students who are not just fully involved on my officer team I do have another three you guys can all come up at the same time if you want um and they've either our second years or first year razors but they can introduce themselves to you guys hi my name is Lynette Lopez um this is my second year raising a market Pig at the Ventura County Fair and I plan on raising another one hello my name is is this was my first time first year raising

019a goat for the Venta County Fair hello can you guys hear me oh hello to you guys all my name is Daniel Gutierrez and the past summer it was my second year raising a market Pig for the ventur county fair um I did take 29 students this year to the Ventura County Fair we did not beat our record last year I think we had a 42 that we took in but this year I was a oneman team so I'll take it um though in terms of the fair we did have the 29 we did have within the 11 divisions that we did compete in with market and Showmanship we did make the final cut for 10 of the 11 which is a huge accomplishment for me um again we had Miss Taylor and she told

020me she wants to sweep the fair this year so we did and she's coming back for next year um on top of that though just a little rundown of what I hope you guys to see this year um I do want to show a lot of Industry I want to do a lot of Industry involved ment and exposure this year within my classes and for my students um like Mr Coro said I mean these students don't know their talents until they can push their talents so that's kind of what I plan on doing this year I hope and I hope I can achieve it um though I have honestly some of the best kids that I can ask for so we'll get there thank you thank you so much uh do we have any questions

021or comments from the board for our FFA well group I would just like to encourage you I mean I'm super proud of how you all did this summer and how you and and all the sectional officers we have here but but take advantage of everything the FFA offers as far as programming because it was I attribute a lot of My Success to FFA and and the the guidance that I got from from my adviser Mr Johnson who who was there for a long long time um you know they it as you all know FFA is like it turns into a big family it's a big support system you guys are all encouraging each other and even if you don't go into agriculture it's a fantastic base take advantage of the public speaking because that's a

022super important thing that you can apply to anything the financial part of it the recordkeeping that's going to you're going to be able to apply that to anything you do in life and and the responsibility that you get from not just the animal projects but any those SAE projects and the life skills that you're going to get with the you know the plumbing and the welding and the electrical um those are all going to serve you all you're going to be miles ahead of of of your peers when you go off to college or into your careers so it's a really great program as you know and and I would keep trying to recruit more kids go talk to the middle schoolers and get them um not just the eighth graders that are coming up

023but the but the seventh sixth and seventh graders and and and we'll continue to build the program and it'll be the best one in the in the South Coast continue to be the best program in the South Coast so super proud of you guys yeah well I I would just like to to tell the students that I'm very proud of Miss Garcia she was a student of mine when I was the principal at Kino so I've seen her since she was in kindergarten and she and I were having a conversation a couple weeks ago and she was telling me all about the program and what she's been doing this summer so congratulations Emily thank you FFA we really appreciate you coming here this evening and taking some time to share with us and uh Miss

024Garcia we are absolutely impressed with what you did this summer so um we're here to support you all of you you um and uh yeah feel free to reach out to any of us um whether it's FFA directly related some of us are a little stronger in that than others um or public speaking or whatever it may be we're we're here to help you all and support you so thank you um okay we now have public comment for uh on our FFA presentation this evening so please step up to the podium now if you'd like to make public comment thank you thank you and um like we did last week elected employee leadership and the teachers and support staff we represent want to commend the success and diligence of both our FFA students and Miss

025Garcia um Emily uh even with teacher resignations over the summer the program remains robust in the hands of Miss Garcia and we are well aware that the current condition of FFA didn't just fall from the sky um ffa's success has been a combination of collective energy grit and commitment by both teachers and all these kids all these students in many ways these FFA students and their teacher have provided the community with a truly shining example of what is possible they should know that their participation serves as a beacon that draws their peers it draws District families it draws donors and future students like my own uh daughters that have been looking at FFA and visited FFA over the years that are really like the idea of doing that uh and uh it's just this enormously

026robust program each of you deserve to take pride in what you've accomplished and uh as you do uh in the community uh with I'm sorry um as do those in the community with uh who provide voluntary service to the support and to support the program like for example Ramone Flores and ARA Kinton uh Mr schaer for example um you not only should take pride in your participation uh it's clear that you do take pride in your participation and thanks for giving us all a truly genuine example of Excellence um there's simply not enough of that going around and um we really appre appreciate it so thank you bra any further public comment on our FFA presentation this evening okay thank you all so much you're welcome to stay or you can take off if you

027have something homework Sports okay well there you go y thank you okay we are now going to move on to our superintendent report thank you uh tonight I'd like to uh Begin by recognizing our cusd employees students and families for a very smooth opening for the 2425 school year last Thursday we were ready to greet 1,937 students our CHS held ninth grade student orientation with the warrior crew last Tuesday August 20th and CMS held their grade six student orientation on Wednesday August 21st both of our elementary schools held meet and greet with popsicles last Wednesday afternoon our enrollment summary indicates that we have 1,937 students which is 26 more than last year at this time measure you that's our biggest news The canalino Learning Center project continued with waterproofing of the building Foundation soil export

028backfill and paction were also completed at the foundation perimeter but the Highlight is the modular building which composed of five huge units with a huge crane uh they were set today it was very exciting started at 6 o'clock this morning yes so very exciting so now they'll Weld and they will complete the exterior flashing and um continue with the project site work so it's very exciting the Aliso TK kindergarten classroom build building project remains in the construction documents phase of services and we're working with local the local permitting process at this time thanks thank you any questions from the board on the superintendent report okay public comment on the superintendent report please step up to the podium now uh thank you regarding Miss Rigby's appreciation uh appreciation for CD employees students and families who supported

029a smooth opening are certainly deserved uh many served in important roles that influenced to what went right and Union leadership appreciates those employees students and families as well um it's certainly appropriate to celebrate successes where they exist um but we shouldn't stop there it's also important to identify opportunities for improvement and stay laser focused on how we can do just that improve over time to that end Union leadership received reports from select District school sites in regard to the app of the most some of the most basic instructional supplies required to deliver quality lessons and coursework at the start of the year for example um an adequate number of functioning copiers or paper literally just paper it um two School sites and other routine Supply orders uh while District administration spent a fair amount of

030time this summer interestingly collecting and throwing away personal items that they felt serve no purpose in the classroom um they seem to miss at the priority focus of on the most important details of their role is to support those who work directly with students and families every day in and out of the teaching and learning environments maybe next year or even before the end of this one District administration can focus on how to deliver those critical resources that faculty and support staff request at the beginning of the summer that um some of them just arriving this week of course um some school sites did much better than others uh CHS and Aliso serve as shining examples of what went well um but maintenance calino and the middle schools administrators seemed awfully distracted with the demonstration

031of their Authority and who is in charge instead of actually using their authority to support the mission regarding enrollment Union leadership is pleased to recognize that in some areas the long trend of declining enrollment under miss ry's leadership may be stemmed if the district's enrollment projections are correct cusd has begun the 2425 school year with 26 more students than last year that reflects a 1.3% increase in student enrollment examining uh declining enrollment closer we're compelled to mention that after miss purso leadership at canalino Elementary the school has experienced a fifth straight year of declining enrollment the union has already shared concerns tied to the programmatic changes in management style Miss purson has in continues to pursue um administrative actions that directly correlate with that 5-year uh declining enrollment Trend now that principal pursu has been

032pulled from canalino and transferred to CMS we ask District leadership to more closely monit monitor her ability to maintain the student population currently at the middle school the high school's ability to provide more robust programs and course offerings uh both athletic and academic is somewhat contingent on keeping those Middle School families in the system and lastly we inquire upon why or when the CD will survey the community to better understand why so many children who live in the district's boundaries are not enrolled in the district it would be well to better it would do us well to better understand the decisions of our neighbors and peers than you your time is up if anybody else would like to make a comment on the superintendent report please feel free to step up to the podium at

033this time hello Carpenter resident for many many many many many years uh I listen to your uh superintendent boort um and uh I think that uh I didn't hear your goals for this academic years what changes are you making to uh improve uh GPA in general uh about about new programs for special at students Hispanic students for example and uh that's my concern like uh it's the beginning of the year and it's it's all right to uh look for goals set up goals and uh achiev them throughout the Academic Year for example uh yes it was great that that we have 26 more students that's okay uh what about throughout the years I think that 50% of uh academic of uh high school graduate uh graduates they were saying that on surveys that they were

034not ready for college it's on the videos uh whenever it say something it's based on what you have said in the past what you're saying now and the videos that they're right there so I think that uh it's a good time to uh set up goals for every students regardless of uh ethnic backgrounds regardless of financial status everyone everyone and uh that's a good point to start with thank you thank you um I'll just just uh mentioned that um things like the lcap and and all that is the review of the annual goals we actually have our superintendent annual goals coming up um that October in October that we're going over so um that is an annual um thing that we do uh so there we go any further public comment on the super attendance

035report okay moving on to public comment for items not on tonight's agenda if you'd like to speak to something that is not addressed within tonight's agenda now is the time to step up and to the podium and make comment thank you so much thank you an update on the collective bargaining process uh after the 2023 24 negotiation cycle began in April of last year several challenges ensued uh the and if this sounds familiar it's because not not much has changed since the last time I spoke um The District's unilaterally the district unilaterally canceled 11 of the first 14 bargaining sessions then in January the district reorganized its bargaining team offering availability only during limited non- business hours refusing to schedule meetings during the workday until March of 2024 Miss Rigby refusal to update the certificated

036and classified contracts uh with the agreements reached between her arrival in 200 17 through 2023 further delayed the agreement and throughout the first 12 months of the bargaining cycle the district not only rejected each and every one of the over 100 proposed employee contract improvements including every proposed safety Improvement C USD also refused to provide any explanation for their rejections until May of 2024 well over a year after the process began the district's response to Legal Information request was lethargic incomplete and or non-existent debt times further complicating our ability to reach agreements based on realistic and accurate data seems like the district was gunning for impass to be honest um employee leaders declared impass in June though when it was abundantly clear that the district was not taking either the process or employees contract proposal

037seriously and after clarifying what had occurred the California public employment Relations Board confirmed our impass request within days meanwhile during the same period of time District leadership approved not one but two salary increas es for themselves amounting to 10 to 12% while offering district teachers and support staff 2% in that same period of time throughout the summer Union leadership offered a offered and scheduled dates for the required impass mediation sessions hoping to resolve impass before students and families returned to school just last week unfortunately the district canell scheduled meetings and then alleged even in the summer that cusd had no space or room available to meet with employee union lead leaders and the state mediator get that no space on any District campus five School sites three facilities All Summer Long employee leadership then confirmed

038it is available um for meeting dates off uh offered by the mediator on September 17th or 19th but the district has not responded to employees on that topic since late July it appears the district is determined to use the potential for disruption to the daily schedule of our district families as well as disruption to the teaching and learning environment as a bargaining chip going forward that's unfortunate hoping to avoid such disruption we ask District employees and community members to support all efforts to better inform District leadership about how that would work and about how resolving employees needs will help to ensure the mental physical and emotional wellbe of the district students and District families this school year thank you any further public comment for items not on this evening's agenda please step up to the

039podium thank you hi I'm a parent at canalino and carpent Middle School um Miss puron had sent a message saying you guys are voting on the cell phone dist uh cell phone the cell phone policy um so I wanted to come tonight um cell phones play an essential role and student safety although phones will be in the office for emergency situations sorry that is on the agenda tonight this is for public comment for items that are not on the agenda so wait until that it's it's literally the next item we're almost there thank you are are you looking for public comment for items not on the agenda okay well here we go thank you I I think you just turned the microphone off is the light on yeah Hab there we go okay y sorry

040about that that's okay talk to the council members and the and the mayor last night and uh this is what I told him and this basically applies to board members as well uh we know that right now there's four of you but there's five and we got the superintendent we know how you how you think because we show up at board meetings but people out there need to know about are you how you think about situations for example uh talk to uh families English or or non- English uh speaking go with an interpreter I volunteer uh to go with you any time any day and talk to them what are your concerns about education about any problems that may affect your child's education for example uh do you have a housing problem meaning where do

041you live I mean people are they living with you what that your problems that your GPA is not as it should be talk to them that's the way you can know exactly what students at what families are going through sending emails or not Liv in your comfort zone does not help have to leave your comfort zone meaning if you happen to run into a parent who don't speak English believe me there's a lot there's a lot of them find out find out how what they're going through do have a budget problem do they you know what I mean your time is up that's what I meant thank you any further oh we got one more here good evening Julie sigwart uh former parent that went through my son went through all the grades I wanted

042to talk about um prior to M Rigby being the superintendent we had a couple superintendent and one of the things that they did is that they had a monthly meeting for uh parents and other stakeholders and there would be some teachers some parents and we would all get together in the in the district office and we would talk about the things that were important to us and that was really helpful and you know that level of communication with the superintendent was you know really amazing and I would suggest that we do that again if you're open to it um I have a lot of concerns about you know going into this year I heard that there is another special ed teacher who just resigned and we've had a huge amount of churn by the way

043Jamie my offer to write letters for a special ed still on you know still out there you know I still want to help wherever I can you know the thing is is that we need to approach these problems you know as a group you know you need to be welcoming our feedback and you know let us help because right now we're headed I mean the way that things are headed now it's it's a bad scene you know I hope that special ed can improve you know I don't I don't know what is going to happen there you know we have four different lawsuits for the molestation cases we have the lawsuits going on with Jay hotner and you know there's potentially other things that are happening you know perb and so forth and I'm really

044very concerned about you know what's going to happen with the budget this year you know thank you uh Jason CF for meeting with me you know I just met with him to give him sort of like an overview of you know these things I'm telling you right now my concerns about the budget you know where I see things just going south because it could go really bad if everything you know uh with the lawsuits you're kicking the can down the road as much as you can I get that but you know if things don't go your way how many times can you appeal things so anyway that's that's my two cents and uh you know I am I do want more communication with the district you know we've had it before and it would be

045good if we returned it again thank you thank you um so I just want to clarify I believe what seet was referring to was the parent advisory committee meetings um that does still happen correct yes yeah we meet every month yes that's why I thought so okay um okay seeing any no further public comment we are now going to move on to E1 board policies okay uh board policy and exhibit 6163 point4 student use of Technology update second reading the board is asked to approve the second reading of the updated bpn 6163 point4 student use of Technology while current cusd board policy 6163 point4 student use of technology and exhibit restricts the use of cell phones in classrooms the district leadership team is recommending further specific restrictions Governor Newsome proposed a Statewide limitation or ban

046on cell phones in assembly Bill 272 however there has been no further action due to mixed support the recommendation is to approve the following change replace number one and number two in current board policy 61 63.4 student use of technology and exhibit uh paging and signaling equipment devices including cell phones pagers camera phones smartphones SmartWatches and personal digital assistance TK through 5 students are not permitted to possess cell phones pagers SmartWatches or electronic signaling devices on campus grades 6 through 8 students are only permitted to possess cell phon SmartWatches or electronic signaling devices on campus when any such device remains off and stored in a locker backpack purse pocket or other place where it is not visible on campus during school hours or activities grades 9 through 12 students are only permitted to use cell

048compromising their safety an outright ban on cell phone use is overly controlling disregards the ability of the students to manage their devices responsibly it also oversteps parental rights by removing a tool that parents may consider essential for their child's safety and communication instead of taking such a drastic step we would we should focus on Guiding responsible usage schools have the opportunity to develop clear policies and educational programs that teach students how to use their devices appropriately for example the Santa Barbara school district has implemented a cell phone Hotel I just brought a picture just so you can see it goes in every classroom um this method minimizes classroom distractions while still allowing phones to be accessible when needed their code of conduct also includes clear guidelines on when and how phones can be used emphasizing

049respect and responsibility maintaining cell phones on school property is crucial for safety and respects the role of parents in their child's lives effective Solutions should address these concerns without resorting to overly restrictive measures that overset the parents rights thank you and I'm sorry your name again I'm a parent at c um Middle School okay um parent um sorry say that Daria Daria I just didn't know how to address you sorry okay hi Daria um I just want to say so students at middle school I just want to be clear are still allowed to have the devices on campus they aren't left in the office noed away back in your backpack or your pocket even locker and turned off it's um not permitted to possess is at the elementary school level um and that is in

050line with um with well let me start with the hotels from the presentation and what I've heard from uh Mr Coro and others is a lot of students started bringing essentially a fake phone and putting it in the hotel and then keeping their real phone and actually still using that so the district has had phone policies um but I I just want to I appreciate you coming and and talking but there have been a lot of steps before this um so I just I I I'd be happy to talk with you more um but so it's My worry is like um the teachers can record like if a teacher records a teacher recorded my son um without his permission and then he went to record her and she said that he was harassing her so

051it's just they don't have any protection for themselves that's my concern but a staff can and I don't think that's fair students don't have that same right I'm I'm not is discuss okay oh I have it doesn't go anywhere she's useless okay so um I just wanted to address what I had heard a couple of the issues um I understand what you're saying I'm hearing you um and I appreciate you coming and commenting this evening thank you any further public comment on E1 yes thank you um first special thanks again to State leadership for doing what district leaders in our district like yourselves refused to do for several years even after being advised upon what seemed so obvious to teachers and support staff working directly with students now that you are provided the political cover

052for um from those much braver than yourselves Union leadership is pleased that you will take a step closer to being being on the right side of this cell phone issue and that alas you are actively working to minimize the variety of detrimental impacts mental social and emotional of unfettered cell phone usage on our district campuses by students for years employee leaders not just myself but many others have been seeking Common Sense policies like those being considered now we've done so in hopes of better supporting the academic and social atmosphere on our district campuses as well as the well-being of our students and again faculty and support staff saw the impact of the CD's extremely loose cell phone and Tech policies many years ago we saw how the district recorded rules in any one of the

053conflicting discipline policies that existed but then openly refused to enforce the rules rules in the cusd board policy unenforced rules in each of the school sites discipline policies unenforced rules and policies recorded in the cusd student parent handbooks unenforced and when teachers support staff and their representatives brought these concerns forward Ward we were first dismissed and occasionally mocked when that didn't silence our concerns we were directed to look the other way we were specifically directed at times to ignore these issues at the risk of discipline and when that didn't silence the voices and concerns and documentation being provided to District leadership Miss rgy and select District administrators some who are not with us anymore uh chose instead to retaliate against those people and attack them with illegal disciplin action which you're now dealing with why

054don't uh we don't share this to say we told you so we share it because you owe many employees an extended apology and because the district is still pursuing some of those legal actions illegal actions by the way declared by the court based on the very misinterpretations that it baked into its illegal disciplinary attacks against employee leaders who dared to speak out a tax that the district is still pursuing at the cost of a half million ion dollar since January and several million dollar in the Years preceding January and how many more million dollars of taxpayer money will be wasted before it's all over all that in mind please understand that although employees are excited about the potential return to sanity that may come with a cell phone prohibitions like the ones in this policy

055it may take a while for employees to trust what you are sharing this evening add that the district has not discussed one time with employee leadership not one time its thoughts specifically on this topic Union leadership will do all it can to encourage employees to trust and the policies to prove any further public comment on E1 hello again um I just wanted to say thank you for this uh um these new rules I think that this is really going to make a big difference when my son was in school School the uh cell phones have been a big issue for a long time and uh I think it will go a long way to restore the classroom atmosphere to where teachers are you know more of the sole person controlling the room uh you know

056there's things in addition to just having a cell phone you know there's these things like oh you have to have the most newest cell phone it leads to sort of like you know uh teasing and you know people not being nice to each other and you know as long as they're able to have cell phones at all in the classrooms there will be kids you know on them so I really really am I'm very supportive of this and thankful of you know this new rule and I hope that you know you're able to uh you know enforce it and you know create a nicer atmosphere for the kids to be able to learn and you know hopefully this will go somewhere or you know a ways to helping raise our test scores and you know

060um but we would like to remind the school board certainly the superintendent and our administrators that unlike previous cell phone policies or dress code policies or drug and substance abuse policies or policies pertaining to receiving donations from drug and substance producers locally um student discipline policies the uniform complaint policy ar1 1213 um policies where um employees can register complaints and they're supposed to be a system followed when that happens um Union leadership asked that the CD be considerably more diligent about how it implements these policies and enforces these policies and actually doesn't just write them on paper like many other policies that you do stick them in a vault somewhere and then ignore them okay please thank you any further public comment on F1 bp410 okay seeing none may I get a motion to approve

093uh we are so concerned about this um uh concept of missing costs that are going to the law firm 3F is that um as of this time uh the superintendent's um special offering that she brought with her um has earned uh last week it earned another $63,000 in fees um in in early August and um this evening the warrant was silent on how much the district has spent in the last two weeks uh but this is for certain that they are hard at work um cooking up more charges as they prepare for the lawsuit against the state hoping that they can sway or confuse or trick the judge into reversing the unanimous decision awarded to Union leadership last winter uh that same decision that um part of that being informed that illegal um practice by

094the district that was part of that being informed formed by the cell phone issue that we brought up earlier that you all brought up and we commented to earlier uh unfortunately C isn't moving fast on this because they know that in part the process in this case is the punishment um few believe that District leadership with these legal bills that were seen on these warrants and this warrant specifically um actually expects to win these cases or these appeals but the longer the district delays the longer it enjoys the benefits of the pressure that they pursue and the disruption that they accomplish uh after investing approximately a half a million dollars in just the last five months to add to the already several millions of dollars spent in the previous 12 months um you can expect

095to see more of the same expenditures on the next warrant um and as long as CD misappropriates these tax dollars to defend itself against its own failed performance here is where these taxpayer dollars are not invested and I'll remind you again we as we have in last meetings the district will not invest these millions of taxpayer dollars towards class size reductions which are one of the most reliable ways to ensure student participation and engagement the district will not invest these millions of taxpayer dollars towards more robust Transportation aimed at increasing enrollment decreasing tardies and absences and even expanding our regional Sports programs to include the Middle School the district will not invest these millions of dollars towards reopening kitchens at all district school sites where fresh meals are both cooked and served daily versus just

096served the district will not invest these millions of taxpayer dollars towards improving the condition that might stem The Exodus of Highly qualified talent in our special education program uh leaving leaving the district right such as increasing classroom support in the form of more instructional AIDS or lowering case numbers for special education teachers or for better supporting behaviorally challenged students migrant ed students or English language newcomers the district will not invest these millions of taxpayer dollars towards improving the economic stability of District employees which in turn will help them better focus on their jobs and even provide theary services they do thank you your time is up any further public comment on G1 the warrants this evening okay not seeing any may I get a motion to approve I move to approve the uh warrant as

097amended I second okay any discussion okay uh all in favor I I okay moving on uh to two G2 uh gifts grants donations donation from Rotary Club of carpentera to unified carpentera Unified School District music program the board is asked to accept the following donations from Rotary Club of carpentera from the proceeds of the annual rotary Talent showcase to Carpenter Unified School District music program CMS new exploratory music class and marching band uh we have um as listed here it says various musical instruments valued at $8,750 as well as instructional Publications valued at $760 and I would just like to point out um as I pull it up what these these items are specifically because that deserves being stated and celebrated um we are looking at 20 debe drums 24 recorders 22 nylon string guitars

09810 headsets for piano instruction various instrument wall hooks one Bongo Conga combo drum set one set of Windchimes with a stand one set of Temple blocks with stand one set of Tony mallets and a performance Podium also included with the donation are remaining items that complete a previous donation for the CM M merching BAND one tuba harness one set of bass drum mallets and one set of snare drumsticks um and within their letter they say we recognize the personal social and educational benefits the study of Music can provide students research shows that students who are fortunate fortunate enough to engage in music exhibit the following benefits improve competency in Reading in math enhanced communication and social skills greater self-discipline in patience and many other critical life skills um and this also States the instructional Publications

099which include um instructional booklets on drum Guitar ukulele kids piano and essential mus musicianship a comprehensive Coral method um so we I just felt it was really important to State all that in this encompasses um because I'm very excited for it yeah so most definitely uh any questions from the board it's great we thank the noon time rotary for those donations public comment on G2 I'm super excited to hear about this donation music has been uh very important in my son's life and uh it I know that one of his teachers uh when we would go to concerts uh this is at the community college he would thank the parents for you know allowing your kids to have this gift of music music uh it it helps in mathematical skill you know it teaches you

100know meter and beat and time and there's a lot which it helps with mathematical development it also helps uh with you know General uh being able to socialize with people and we have so many you know so fewer opportunities with the whole online life that we lead nowadays and to have kids interacting with each other and with teachers and learning how to be humans and you know putting themselves out there you know this is a great skill and a great gift that you are giving to the kids of the district and I thank the Rotary Club for that amazing donation and super happy to see all the percussion and you know that's just going to make a real big difference in a lot of lives I'm thrilled to see it thank you thank you all

101righty so cause leadership and the employees we represent want to thank those and community members who provide grants and gifts to the CD without any unethical and unprofessional strings attached and this is an example of that um this time another generous donation from Rotary Club of Carpenteria over $99,000 in musical instruments as you said drums recorders head headsets Bongos Windchimes Temple blocks timony mallets and other items to help support a robust music program in the district which in turn supports well-rounded and robustly educated children like Miss sigwart was speaking to um these gifts with the monies these gifts along with the monies the considerable monies from the state that uh were recently provided in the last few years are going to a long way to a last rebuilding the music program that we once knew

104resolution 24930 emergency resolution for districtwide backflow preventer installation from &m Mechanical Inc the board is asked to approve resolution 249 9:30 emergency resolution of the Board of Education of carpentera Unified School District County of Santa Barbara State of California authorizing Award of contract without bidding the carpentera Valley water district informed the district that the school sit's water connections require an air gap or reduced pressure principal assembly to be installed at their water meter in June the district obtained proposals from this for this work from Mall an em Core Company and Eminem mechan after reviewing the proposals the district proceeded with the lowest proposal which was from &m mechanical the installation of these RP connections or backflow installations require the water to be turned off at the school site so it was imperative that this work

105was performed prior to the beginning of school the cost of $4,475 will be paid with RR ma funds any questions from the board uh I don't know who who to direct this to but the um ask me yeah so we just to be clear we had backflow preventers on there we just had to update them to the current standard is that yes in the third week of June the water district informed us that by by July 31st we had to do an update so this is a requirement are those the ones that were in the street that you would see out in front of canalino they were they' be right off the water yes right off the water they have to be between anywhere we draw water and the connection to the to the main

106uh Municipal line um just surprising that they wouldn't have allowed us to Stage them you know to to to do them over a period of time what's surprising is the letter was dated April and we only received it June 22nd yeah and then it had to be done by July 31st okay public comment on G3 Al righty um so thank you for putting this agenda item and on the agenda and also clarifying A little bit that's helpful um uh so at the last board meeting on this in regard to this company and the work that they do which is being um somewhat replicated here um the union asked a very specific question during the consent agenda period uh and uh it involved the kind of work again that is on this very um on this

107very agenda item um we asked if someone could explain why cusd continues to award contracts to Eminem mechanical which is a plumbing contractor for services that are out of the scope of their license such as carpentry jobs uh building walls installing subf Flo Etc we ask that you seek um some background on that from Mr petite and maybe even Mr Schaefer um how that would be the best use of public monies uh this item specifically is exactly what we would anticipate from um a school district that is seeking bids from licensed qualified um contractors um this one here is has to do with things that fall clearly under the scope of the licenses that Eminem mechanical possesses so we just want to make it clear we have no beef with Eminem mechanical but we do

108have concerns about when the district employs contractors that are not working under the scope of their license and especially when there may be relationships that go beyond um uh Beyond uh your um you know or the district's professional responsibilities okay thank you I just have a quick question it says that this is going to be paid with rrma funds and I was wondering what the rrma stood for and uh if that's like uh specific to you know um repairs or if this is something that could be done under measure you so this can this is not appropriate for measure you okay um this is routine maintenance which is I apologize for all the r but if you wouldn't mind I restricted thank you routine restricted maintenance account perfect thank you yes thank you okay um

110need to wait after the next person if there's another commenter please step right up all righty so of the 13 positions filled um yourselves in the community should take note that four of those positions are special education teachers and three of those positions are special education instructional assistance which Mees more than 50% of the recent hires that fall into the special education department where all the openings are while being told by our esteemed superintendent attendant that there's nothing to see here and we have no problem in the special education ranks okay another thing you should notice on this is the resignation of Miss Garcia um there is a uh let's see we have two special education AIDS and we have one teacher although the district conveniently it seems did not mention that Miss Garcia was

111a special education teacher and that's what we'd like to focus on here for a minute uh because that's an important detail as mentioned earlier in the meeting we've already had our first special education teacher resignation on the second day of school because quote Miss Garcia said I did not feel supported I have been a special education teacher for 30 years and the way this District runs the special education program is one of the worst I have experienced Union leadership appreciates the cander Miss Garcia 30-year sped veteran teacher shared in her letter to The District administration and we wonder if the school board was made aware of this letter which was sent directly to miss Rigby and sped director Haynes to be candid the sped program at cusd under Miss R supervision has been fairly dysfunctional

112and it only took this veteran sped teacher about one full week to recognize that dysfunction the danger it presented to her professional reputation as well as the students in their families last year CS cusd had to bring on a new sped director in September who bailed in March as did 12 special education teachers and many instructional AIDS superintendent raby's response to missar was TR at best Miss Rigby responded quote hi Jennifer I've received your email and resignation I'm sorry that our district was not a match for you Diane Rigby this response contained no effort to better understand what Miss Garcia's reluctant decision or the many details that she shared in her letter nor did Miss R's response inquire upon the impact on the students or how Miss Garcia's concerns might be improved and the superintendent

113didn't inquire further upon this resignation because Miss Rigby is and has been well aware of the dysfunctional conditions that she supervises and at times it even seems to promote and superintendent rby is well aware of the impact on the students and the sped families as well just as she was when she was awarded a unique Honor by a federal judge when she was the first school official Nationwide to be held personally liable under the Civil Rights Act for violating the rights of special needs families so as we watch Miss rig further deconstruct the cusd sped program and what appears to be and it just appears this way we sure hope it isn't but it appears to be payback for your extraordinary frustration with special do we have any further public comment on the Personnel summary

116the freedom to grab my kids and go do something in the middle of the week when you know you have I have a little downtime at work but there's something to be said for the structure um of a school day the I call it their school stomach um and which is very different than the summer stomach um and uh and and anyways it's just it it's it's a new year and uh I want to thank the city of carpentera actually for running a a little campaign reminding residents to be careful on the streets in the morning on their commute and on the way home for our kids um and and I feel like as a town we've been doing pretty well uh I haven't heard I I I feel like our crossing guard uh that

117I see each day canalino um last year she was doing a lot of fish shaking at cars that were not being responsive and I haven't seen nearly I don't think I've seen any of that so far we're what 4 days in so um thank you to Carpenteria and our drivers for keeping an eye out for our kids um and their safety uh just this last weekend um I had brought it up at the previous meeting we had our fish for life um event uh up in Santa Barbara and um and it was again just really magical it's a free day um out on boats uh fishing for the day for special needs families um and it it is genuinely magical and it is uh something that I look to build um and and stay involved

118in in coming years um we did have uh families from Carpenteria from our school district um as well as uh staff who came to the first event and um and we have a waiting list for next year when we do start these events again and I'm I'm just I'm really excited to see uh more opportunities open up for inclusion and um an opportunity for our special needs families um here in carpentera but also in the general area Tri Counties so um I it was an honor to be a part of it and and and to work with these families uh also sports are back um so really excited to get to some of the games at the high school um and uh volleyball going water polo uh cross country football um tennis thank you I'm

120acquired another child which is great so welcome Andre Okay um moving on to Board calendar anything of note on the any changes okay um future agenda items we have our solar update for the high school the solar project uh superintendent annual goals the 2324 un audited actuals and a staffing update coming up does the board have any items any other items they want to see added right now okay public comment on K future agenda items thank you again there's two uh agenda items I'd like to see added for the future one is a policy on how the items in tonight's uh F 1-8 will be implemented you know strict you know because you know I've seen things like in the past like the dress code policy gets enforced in different ways between different teachers so

121you know I'd like to see how we're going to implement all of these policies because the I thanks Mr hotner he gave me some of the um the documents that outline the procedures and there are a number of places where it says the district or you know you will put together Implement a plan and so I want to know what those plans are and then the other thing I'd like to see added for future agenda items is an audit on the whole special ed um program and uh focus on you know what we doing there what we have done wrong how we got here the future challenges I know that I've talked to Jamie Diamond about you know how the costs are just going up and up and up and up and up and how

122you know we're getting more students and so it would be great if we could you know really dissect that program and take a look at it because you know there's there's a lot that isn't great there and it would be great if we can you know work to make it better and uh you know I once again I think more brains you know more people approaching it you know maybe we can all come up with some solutions together and you know make it work and you know really shine a spotlight on what's going on there and fix it thank you thank you okay oh looks like we have more all right so given that the district and its employees are currently at impass in the bargaining process and that Union leadership wants to do whatever

123is reasonably possible to avoid A disruption to the academic environment we again encourage a focus on the methods and actions that may help the parties get to an agreement we request that cusd includes on an upcoming board agenda and and soon please an exploration into how contingency formulas can be used to resolve uncertainty around employee compensation at the last meeting we asked the new assistant superintendent Mr CF to explain to the board and the community how contingency formulas work and how they can be used to improve Labor Relations budgeting and fiscal solvency Mr CF we didn't hear from you on that but we hope we do District leadership is well aware that for the last several bargaining Cycles the 2324 cycle being no different the union has proposed using contingency formulas to resolve perhaps the

124most challenging single area of contract bargaining not the most challenging all the time but often one of the most challenging compensation and benefits a contingency formula would allow District leaders and employees as represented by their elected union leaders an opportunity to depersonalize the conversation by using a fairly impersonal formula that ties actual District revenues which are anticipated to arrive in the future to employee compensation this concept is really pretty simple for example a data point is established such as a routine labor cost coming in maybe that's 85% or 84 or 87 of the total District's expenditures that an agreement is hammered out based on the availability of the actual funds that exist in the future versus having to guess and the uncertainty and anxiety that guessing creates for both parties for example the partners could

125agree to apply all or a portion say 85% of the actual future revenues towards employee compensation and benefits in a given year out not only could a contingency formula resolve our compensation disagreements in years out it could also create a bargaining atmosphere where the district and employees are on the same side of these challenging Financial conversations rowing in the same direction which you've heard me say before sharing our fiscal opportunities evenly and enduring our fiscal fiscal challenges together as well imagine Administration and employees on the same team think of all the benefits the largest chunk of fiscal uncertainty removed the district's ability to budget more accurately into the future achieved all the time an enormous expenditure of money to C usd's La Legal firm reappropriated to focus on other critically pressing matters less confrontation more

126teamwork and again everyone rowing in the same direction we're confused why we didn't hear back from anybody on that we're confused why you haven't put it on a board agenda and we ask again do we want to resolve the conflict or not your time is up we certainly do thank you your time is up okay thank you uh roio delado carpent resident I mention Carpenter resident because I'm a Community member meaning that each meeting I show up to express my voice my concerns and uh to uh two things one is that there's three of us over here at every board meeting nobody else nobody else so if it was for us you wouldn't be yes by yourselves isn't that right look at what the city does they use zoom Julie probably three months ago or

127so suggested that the board should use the zoom device as well that way people can communicate from the outside that's time I couldn't show up so my voice wasn't heard cuz there's no zoom and believe me that's commun that's Community communication I think that we need that another future agenda item probably two months ago or so I said well why don't you put it on the agenda the brown act let's discuss that you have read that haven't you it's the rules and regulations of school districts board members city government we need to understand that what's there and interpret it the same way because the the way I feel it is that you may say yes it's within the brown act and I may say no it's not or vice versa so uh superintendent Ruby you

128have the power just right now to uh uh address stuff put it let's put it on on the agenda right now now brown brown KN discussion you can do it you can so I think that we should all benefit because even yesterday at city council Brown KN show up over here we need that thank you um I will say we did respond to the brown act question in that we said we are going to be including that in our um uh board retreat uh when we get that scheduled um we were waiting for the election to see if we had you know who would be coming on and uh but also Brown Act is uh there's a course that all board members go through um at the beginning of their term and um so um
