it's a niche that one minute Mike's alive thank you Patrick oh away from me give it no I'm good okay I have no strength in my left leg good evening welcome to the December 15th Chico Unified School District Board of Education regular meeting we will be going into executive session is there I there are no visitors wishing to speak to Executive sessions so I will adjourn to Executive session and see everyone at six o'clock for our regular meeting okay good evening everyone it's supposed to open the meeting the board has been enclosed session since five o'clock I have an announcement about an action that was taken um the board voted by a unanimous vote to pass a resolution to reject a claim brought pursuant to the tort claims act and to give the claimant notice
of the done aisle that was the action okay open the meeting with the flag salute please could stand and salute I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all thank you okay this is now our organizational meeting where we will vote to elect our officers for this upcoming year how this process works is we will begin with the office of president after filling that office we will go to vice president and then Clerk and then Secretary of the board so we will begin the process and I'm going to open it by nominating Dr Kathy Kaiser as president nominations do not have to have a second um it's now anyone else would you like
to nominate anyone for president here oh go ahead Tom okay Caitlin dalby has been nominated Brent Caitlin are you willing to accept the nomination yeah I'll accept the nomination thank you okay and Dr Kaiser I forgot to ask you that same question yes I'll accept the nomination okay we have two nominations for president any further nominations are we finished with president looks like we are finished okay the first nomination is for Dr Kathy Kaiser to be elected president for the upcoming year all those in favor raise your hand okay we have three that elects Dr Kaiser as president for the upcoming year congratulations Dr Kaiser there's a gift [Laughter] and you are now in charge Madam president yeah the kind of gift that keeps on giving yes yeah okay so our next uh activity is
to elect a vice president may I have a nomination for a vice president Eileen I nominate Caitlin dalby okay I'll accept your nomination thank you Eileen are you willing to accept yes okay another any other nominations only once going twice all right so all those in favor of Caitlyn raise your hand okay no all right uh the last position we need to elect is a clerk any nominations for Clerk all right and Matt are you willing to serve okay any other nominations for Clerk all right show of hands all those in favor all right Matt's having trouble with this sound oh okay thank you okay so we have we have President Dr Kaiser vice president Caitlin dalby and clerk Matt tennis and then the secretary of the board is appointed and we typically appoint Kelly
Staley and Kelly you're willing to serve right yeah now's your chance to opt out so um we need to set the date time and place of our regular meetings we did get a list of dates was there any uh anyone have an issue with those proposed dates all right um and then um that's awesome no why yes Eileen Madam president um just a notation that if we find um later in the year that because of a change of a holiday or some other movement of a schedule we do have the option of changing the dates as long as we give notice to the public yes um so the time has been that regular board meeting start at six with the closed session at five and special board meetings start at five um and are we
going to continue to use Marigold as our all right so we're going to continue to use this facility as our regular meeting location okay we need to vote on this literally the dates we do okay I wasn't sure all right so uh all those in favor of the dates that we were given as our examples and the times that we've been doing and this location please uh we need a motion first all right okay yeah we do have a point of order we need a motion okay so the motion is to agree to the set dates that we were given the times of six o'clock for regular board meetings and five for special board meetings and Marigold is our regular place I'll make that motion okay all right point of clarification yes um doesn't uh
closed session though begin earlier five o'clock it's very confusing frankly on the agenda very confusing I mean because the agenda says five o'clock board meeting but it turns out it's only closed session so I know personally from experience that a lot of people show up thinking that this meeting is going to start at five o'clock so we could change how we label that we can put board meeting starts at six and then in parentheses closed at five if that would make it clear okay Eileen uh thank you madam president uh just some background for Mr tennis on the reason for special board meetings are what we call workshops and in other parts of our publication and because staff is usually the most significant part of those meetings with their presentations on certain issues that the
board has selected we we didn't want to have two hours between the time when their work day ends and the time when they have to start here so that was why we moved it forward that and if we involve children in our workshops which we often do it gets them a way to homework and stuff earlier it's um and and you're right it uh having shown up at the wrong time several times it is confusing but that's that's the distinction special board meetings mean Workshop meetings I don't know why we just don't put Workshop okay thank you so was the suggestion that I heard from superintendent Staley that we will simply uh post those distinctions on we certainly complete the announcement yes okay okay so thanks for the suggestion if you're still asleep there's something
wrong with you we oh oh yeah that would have been yeah so John are you going to do that to us again oh God oh God yes I believe we have a motion on our meeting dates and times but not a vote not a vote we had a motion and a second but not a vote all right so if I can ask you then to vote on the again the sample sampheims that we two different times uh six o'clock for the regular board meetings and five for the special board meetings and the place being here will all those in agreement raise your hand on sorry this will be a roll call vote since it's our first vote on a motion okay okay thank you all right well that's why she useful Dolby I okay Robinson
I tennis eye so uh yeah what is the specifics of that so this would be the opportunity for the board if you don't like the order in which the agenda is currently uh presented if you would like to change uh the layout if you'd like to remove items that you don't think are pertinent any longer this is your opportunity to do that or you may leave it in the format that it has been for the past year but yes it was me that made that comment earlier I just think that um anything we can do to spell out the the fact that closed session in the case of meetings which by the way I mean most people lay people are not going to distinguish between a board meeting and a workshop so let's get over
the idea that that there's a difference in the eyes of Joe schmoe public because there isn't it's true so anything you can we can do to give Clarity on the agendas you know about that that stuff and big headline on there saying when the meeting's going to start would be valuable that's all that's all I want to say thank you Dr Kaiser um I I agree uh one of the things that I would like to encourage though now that we have a facility where we can accommodate um public attendance that the workshops be outlined in a way that the public knows that we are inviting them to come to those very valuable workshops there's really a lot of of good information for anyone who has an interest in the school district so I I don't
want us to do anything to discourage attendance now that we have a facility where that can happen the more the merrier in my opinion uh on on that note I don't know if this is actually changing the order of anything but I I would maybe encourage us to just be mindful of putting items on the workshop agendas that when this happened I think one time recently um that may push back the actual presentation from staff for our Workshop topic to to later in the evening like make sure that that stays closer to the beginning of the evening because I think that's what we're talking about right wanting to make sure our public stays engaged um so we don't want an agenda item to come in maybe it's something that we need to speak on or
have a discussion about um lately it's been you know the changing covid mandates or or things rolling out so we've used special board meeting or Workshop times to talk about those and have those discussions even then that's not typical um uh typically that that meeting type um but if we have them before our Workshop sometimes it tends to make our Workshop be later and later in the evening so I'd like to just make sure I don't think we have to like change anything but just make sure that the workshop stays close to the beginning of the meeting and then we can take care of business after that okay is that agreeable okay Mr tennis Mr Lando um I think that if public is here they need to be heard and given their opportunity to speak
you know I mean I don't think you don't agree I think you probably do agree um but um you know if we need to make comments to people like uh trying to encourage speed and efficiency so that we can get to the workshop item I think that's that'd be valuable but but making people come and sit through something that may not be pertinent pertinent to their life and why they're here wouldn't be something I'd want to make them do in order to earn the right to speak and be heard so just for clarification on that point is that we do not have items from the floor on our board workshops so people that come to speak at a board Workshop would be speaking on a topic that is agendized I add our regular board meetings
such as tonight we do have comments from the floor um I have a question my mic is really loud um I think I maybe took all the volume from Mr tennis's make you can hear me just fine all the way back here right um so uh what about the concept of doing timed items which is a little tricky but for that reason you know if there was a particular item we could still get through the workshop which is the purpose of those meetings let our staff present to us all of the the things that they put together for a topic that we've asked them to present on and if there is another agenda item that we need to either have information or take action on that's special in nature we could maybe put that at
a particular time so the public knows when we'll be speaking on that topic um just taking a cue from How The Board of Supervisors does it just a thought I don't know how difficult that would be to do but it would maybe take care of that that piece a little bit you know if the public doesn't want to come here a workshop on our communication or our you know how our special education programs are doing which is the purpose of having that meeting but there may be a topic to discuss later on um after that workshop and we could say that will be on we'll be speaking on that at 8 pm because we know those workshops are roughly an hour and a half long those presentations are are meant to be about an hour
to an hour and a half long so we should know about what time um those additional agenda items that the public may want to make a comment on would be in in that in the evening of those board Workshop meeting nights questions yeah when your mic gets turned down that I can't hear you I it maybe have even gotten turned up because I was asking for well I I am good at talking loud uh so um I just I'm not liking hearing myself talk so much so I'll stop talking how's that yes I mean yeah on on the issue of um the purpose of the two different types of meetings um and special meetings that are held just because of an emergency topic or something which is which is um something I think different than
what we're talking about tonight I um I actually support having people come and and have to not have to well yeah have to listen to the purpose of the meeting the presentation the subject matter being covered and and then speaking on a topic that they're interested I I think it's a valuable thing to have our school public come for something other than a support issue or a complaint issue the business of this school district has many topics and covers many many areas and I think it's important for our parent public to listen to the rest of what goes on to support and run our school district um spending you know uh hopefully less than two hours in most of our meetings well I'm not going to say most because there have been a few that
were over three hours um I think it's important so I just I support um it always bothers me when we have parents who will come and speak for their 30 minutes and then everybody leaves it's like no no don't leave stay um and so that's that's my opinion I have one other thing on the agenda um item number eight negotiations update I don't believe that we are currently making use of a negotiations update time um we we don't have any controversy and negotiations that anyone is interested in Mr Moretti I'm sure would make us all very aware if we were not being good Partners so I would like to take that out in order to cut down on time in the agenda that's that's not being used um that's that's really the last of my
comments Mr Dennis um I have no comment on what you said about the uh just now the um bargaining update um but I want to go back to something you said about how you feel bad when people and I mean this at all good will and respect and and friendship toward you um you don't like it when people say their piece and then hear the hot ticket item and then they get up and leave and as a parent and some of the people who come before this board are going to be parents right maybe a high percentage um I can tell you that it's hard right now I'm out there man I mean the struggle is real you know there's stuff going on at home that that totally demands your attention and you know you've
got to be there for it and you're taking super valuable time out of that to come here and so um if there's a hot ticket item on the agenda in my opinion we got to put that right at the top we got to give those people a chance to come in and say what they need to say and and get out of here not that that they shouldn't know about what's going on in their school district they shouldn't hear the communication program update and you know the maps and stuff like that but you know life is about priorities and people's time is incredibly precious so we got to keep that in mind when we lay out those agendas to put the hot stuff toward the top and and only people who really want to be
here should have to listen to things that don't directly apply to them in a in a super meaningful way right now thanks so first of all I want to come agree with Mr tennis completely we can't we can't control people into into caring about stuff we wish they cared about um so that seems like a non-starter to me um I do like the idea of timed agenda items so people know exactly when to show up for a certain thing um especially because that'll keep us on track during some of our longer we all like to talk I mean we got elected we Meander a little bit I would love to see a schedule that was set so hey we'd have to have the workshop done by X time because then we're going to get a
huge influx of parents who are gonna want to talk about what they came to talk about I think it's a really good idea so in response to that let me add that we now have two minutes towards our anticipated time for student reports so um what I've heard from the group is that having a greater sense of the timing of the presentations of board workshops these are not the meeting you're in now you're in a regular board meeting these are literally special topics and they don't have any uh items from the floor at all in those meetings so is there any other specificity or suggestions that we might want to take I have one little comment and that applies to public comments submitted but that might not be for this item right here I'll leave
that to your discretion Madam president well we've been talking about workshops and they don't have public comments from the right on items from the floor I don't care about that I just meant public comments in general so so maybe this doesn't pertain to this agenda item I I would address that here since we are talking about how we run May needs and the agenda so there's not really another place where it would fit in okay um I think that when people write a letter or an email into the board I think that their name should be published in full no no it's not names are are almost universally stricken from we get it in the email but what it shows up on the PDF document available to the general public it's not it's not it's
stricken out so we were redacting to um so we weren't giving out emails of people that had submitted items um the name I believe we are leaving unredacted correct on public comments but we were hiding the IP address and we were blocking out the email address it shows the oh my gosh him right but the last names redacted and the rest of the information correct I am sorry so we can definitely leave the name we were just really trying to we didn't want to be making public somebody's email address I'm for leaving them in so I would I would move that we um publish somebody's full name when they make a public comment in this very public forum and an important Forum where public testimony is you know should have the backing of identity if
somebody wants it to be anonymous I think they can they can drop an anonymous note at this district office or or maybe specify very clearly please make this Anonymous or something like that my concern is one of your school board's annual Association where the Attorney General noted that some individuals were being physically harassed at their homes from it being made very public what they had said or done and so I'm a little concerned about that if somebody I think we we require that a person give their name but if someone doesn't want their name presented publicly what can we do for them so that is if they are here in person it's not the written comments that they're submitting via email the Red McCombs don't have their names the written comments that what I've heard
it was requested is that the written comments that are submitted to public comment have the name left attached so when somebody comes to speak here at a board meeting from items from the floor not the public comments but items from the floor they do not have to we cannot require someone to give their name at that point two different issues right that's a little confusing um I mean I don't see the distinction between items from the floor versus public comment on an agenda item why is there a difference in the way the name is published or not during items from the floor versus the other board and are attached to the agenda they do not have to be here in person sometimes they may want to do both but they don't have to be here
in person for the board to receive those the items from the floor are individuals that are now in person that have either submitted a speaker card for priority or are here in person and want to address the board and legally we cannot at that point require them to give a name okay so I would just reiterate my motion that I think the people's name should be published when they when they comment to to us in writing so does that motion I'll second the motion all right so the motion we have about the agenda is that only items from the floor that are email comments correct so that would be public comments that are sent to the board yes all right public comment so if you are in agreement with that can I have the point
of clarification um are we are we right now voting on the entire agenda we're just putting this one part and then okay that one point thank you okay yes Tom I had any discussion for a second now all right um just I want to go on the record of saying I think this is a really bad idea um we are in a time when there are really strong feelings by many different groups in this community and effectively doxing people in public if we know who they are and we can verify that they're people who are legitimately have an interest in communicating I don't see what the benefit is in letting everyone who might disagree with them know who they are and how to find them like it seems like we're asking for trouble any other
comments um I think that yeah that's it's tough it's tough because there has been some doxing that has happened in our community in the last in the last year plus um when I as a citizen submit public comment to other governing bodies in our in our area I know that my comment is going to be published publicly I know my name is attached to it and I do that without fear and because I want those people to know my opinion um as a citizen so I would think that if somebody's submitting public comment they're doing it knowing that their name is is published with the comment because it's public comment they can still email the board as a private comment that doesn't get published that is also possible um but to me public comment is
some a comment that you want to make available to the public from your perspective but yeah so the discussion continues my question would be that if someone asked not to have their name made public how does this motion affect that I would put that particular question if it were me in charge probably to legal counsel you know um but uh yeah I mean I would I would say that I'd like to go ahead and make that anonymous you know if somebody wants to write an anonymous email or is able to state to the secretary that they want to be anonymous I would I would I would favor that anonymity yes um there already is a way to not have your comment identified and that's by doing a direct comment to the members of the board
rather than going through the comment section on our website it's the person would be able to do that themselves so I support what you've the motion you've made Mr tennis and believe that there is a way for the public to communicate just one-on-one with the board without having it be you know a public comment for review as published if they're because they're published as part of the record of the of the agenda and and I support that any other comments I have a thought um there are some interesting comments that have been made to our districting some that I think May almost sound like they weren't even sent to the right governing body um perhaps interesting comments um and so I'm I'm definitely flip-flopping here in this in this discussion and thinking like all the
scenarios and um you know those those um those folks their names aren't attached to those comments right now that are posted right it's maybe I think it's just a first name um so do we want that to be an automatic they get outed with their comments um I don't know I'm I'm still struggling with this decision I'm going to just defend my my motion here I feel like yeah we've got things in our society that we're emotional about you know um I mean some of us up here you know we were on like opposite ends of really emotional things but we've figured out a way to you know come together and have intelligent measured conversation and and work it out you know as a small intimate Community um I mean we worked it out in
that we have a professional relationship and we're moving forward and we have a respect for each other so we need to do that as an entire community so like being anonymous and like all sniping at each other you know from across town or whatever is just not conducive to you know coming together and putting our heads together and you know building on the community that we have you know so that would be my my reason for wanting to do that you know there's people in town who just believe way different things but doesn't mean we can't know each other's name and you know respect and appreciate each other you know if people are being violent and stuff like that you know punish the criminal you know be tough on crime is what I would say
in response to that but we can't like all just pull off into our shells just because you know something happened somewhere once upon a time excuse me um that said the history of Anonymous or pseudonymous comment in public discourse goes literally back to the Constitution I mean it's a it's an honored practice for people who definitely want to share with people but don't want necessarily to incur the direct Wrath of people they're going to upset I mean think of the Federalist Papers right like we've been doing this forever my concern would be that um if someone wanted their thoughts known but they didn't feel that they had the resources personally or maybe at their home or their business to be protected if someone knew their name I'd be really concerned then that we never got
their thoughts we only because they were concerned about protection so um that would be my concern or their children's protection or their businesses protection so that would be my concern are we ready to move forward with the vote okay so if you are in favor of all public comments to have a name attached to them publicly uh raise your hand okay that's three okay passes all right so back to the agenda layout um is there any other thing that requires uh emotion it appeared to me that most of these were just suggestions about sequencing what would time items need to be a vote yes yes you need to vote both if you want a timed agenda and you'd also need to vote whether or not you want to remove negotiations from this Madam superintendent can
you repeat what you just said about negotiations so I heard Miss Robinson say that she would recommend removing the negotiations update from the agenda so the board would need to agree as a whole to remove that item and then there was also a recommendation to have a timed agenda and the board would need to agree to that as well what are the arguments so to speak to having a negotiations update on the item on the agenda as a standard item sure there was a time when there was not a lot of agreement between the district and the unions and that allowed it ensured that the unions had the opportunity to publicly address the board and share the concerns and what was happening in negotiations from their perspective and also allowed the district to share with
the board and and the community what was happening from their perspective thank you Mr Moretti do you have any concerns about this item being removed from the agenda no before it was added to the agenda if we had those kind of issues we used it from the uh the items from the floor and then and then during that really tumultuous time it was solidified into the thing as things stand right now I don't know if the public has an interest in what we're talking I mean that would be the only I think you guys get the the reports in closed session um and then if we come to an agreement the public has you know um that that's where they'd find out is there is there a public interest in what we're talking about as
we talk about it I I don't know if that's true and for our members we send it out you know and uh so they know what we're talking about so I have I at this time I have no objection to removing it I'd like to move that we remove the um negotiations update from the standard agenda all right so uh this would remove it as a consistent item in the agenda my understanding would be if there was something going on it could be brought up as a special topic is that correct that's correct and we could certainly always out if there was something that we wanted to update the border that the union requested we could put that under human resources and add that as an agenda item at that point okay all right so
the the motion is to strike negotiation updates from the agenda so if you're in favor of that would you raise your hand all right I think we need a roll call vote don't we oh yeah you're right on the Dolby eye Orlando Eye Tennessee I need an actual motion yes I would like to move to um create timed items on our board Workshop Agenda night or board Workshop night agendas only so not all special meetings but only our board Workshop agendas I'll second that Okay so uh Caitlyn has made a motion and Tom has seconded that the regular board presentations would have a timed agenda correct board Workshop presentations would have a different Workshop presentation okay I'm sorry all right okay so is there any uh just I'd like to offer a friendly amendment to
this um I think it sounds fine the only time I could anticipate a problem is if we had a room full of people who wanted to talk about say like agenda item number two or agenda item number three and then we started talking about it and then 25 minutes in oh sorry folks we have a timed agenda item that five percent of you care about and um so you have to stop that discussion with those people here and they have to listen to something that they didn't come here for and and then before you can go back to it after that would be over that would be unfortunate if that happened as a result of this so maybe my proposed amendment would be Madame superintendent maybe you can help me out here is there any
way to denote what something that might be likely to be a um like a hot topic that people might show up for or would you have um just the president and superintendent together anticipate that something like that might be right in front of a timed item and so therefore they would use their expertise and sense of responsibility to try to make sure that that didn't happen does that make sense yeah it does I mean you know you're hitting exactly on the issue with the timed agenda that when you do have a timed agenda it really does let people know when things are coming up the flip side of that is um if people expect something to happen at a certain time because you publish that and now you don't uh you have people upset because
they've shown up for something that now is not happening at that time so it's really a double-edged sword Arlene one of the things that is the truth about those red uh times uh down the left-hand margin of the agendas those are estimated times and it there's no legal requirement to stick to them what we are required to stick to is when we have given an opportunity to speak each person has three minutes or if the president of the board the board elects to shorten the time because of having to limit the number of speakers to fit within the um the actual required time that the public must be given to speak on a particular item but the the estimate of times down the left-hand side of the agenda is just that estimate has no legal
bearing on closing discussion or anything that's contained in the actual um part of the agenda that is our legal agenda I do want to clarify the the red times is just for our information up here right that's not publicized so the public doesn't see that so um right so um the way that I Envision this working well for both our staff who are presenting at Workshop evenings as well as the public who may want to make comments on our particular item that was added to that Workshop night not because it's a regular board meeting but because it's something timely that we need to discuss and we can't wait till our regular board meeting two weeks later is that we go in the order that that is already laid out which is call to order announcements
consent calendar that generally goes pretty quick we know how long that's going to take um and then we do our Workshop also we know how long that's going to take and if you're talking too much as a staff member presenting we're gonna have to say your time is running out you're it's valuable but you only had an hour and a half to present and you're going a little too long um and so really we should know when we're hitting those agenda items if we go in that order and I think that that's valuable so the the folks that are that are waiting to speak on that really hot topic item um they can you know get off of work go make dinner for their family and then come here you know at 7 30 when
they know that that's when that agenda item is going to come up um because we're sticking to a very particular um agenda uh um layout for workshops this would never work for our regular board meetings but I think for our Workshop evenings when we do have those you know one or two added agenda items that sometimes tend to be Hot Topic items um I don't see it as a drawback to to guarantee that it's going to be at that time because otherwise we can do the workshop our presenters are sometimes have students involved you know get the those those folks through the workshop which is the purpose that we're there that we set in the beginning of the year and and then move on to the other topics on it on a time on a
time limit and then yes use discretion yeah so it's not if we understand that it's not going to be something that we're using all the time just something where the president and superintendent maybe use their radar and spot that this is going to be something it would be valuable to bring it in and I would say as a board member sorry for nothing but I would say as a board member you could even also have input you know know like hey we really need to think about this and send that input to to okay those folks making the agenda and as has happened with this board you do have the prerogative to change the order in the agenda if you see that there's people here on an item that is lower on the agenda and
you want to move it forward and you have done that before okay so currently the [Music] is that workshops have an agenda structure that is structured so people that are interested in that will know a general time when it's going to be presented no I think this is on rare okay if I understand correctly on relatively rare occasion you madam president in consultation probably with the superintendent would choose to make an item a timed agenda item not something that you'd be doing regularly but it's something that you might you know just invoke as as part of your powers to lay out the agenda um so the the motion actually is to do that for every Workshop which is our first Monday sorry first Wednesday of the of the month which don't typically have an extraneous
number of items so it would be somewhat rare to have timed items because we don't always have a whole lot of other agenda items to get through but we would get through the workshop first and know what time we would we would get to the next the next items on the agenda that was the yes Tom but then the uh the system kind of works the other way if we have something we know we need to spend more time on we can temporarily suspend rules and rearrange stuff to make sure that we're giving enough time to people who are if there's an extra you're saying you could move a timed item yeah we could always move to spend the rules if we need to if it's in the Public's interest absolutely okay any other comments
all right so the motion was for workshops I do have a question if there's any particular input that the cabinet would like to give on this on this ID or topic and you don't have to but I'm always curious about your your input since it affects you as well I I do think we can make this work for the board workshops because those typically are scheduled for 90 minutes um I do not see us being able to make it work for a regular board meeting because um you know right now we've already gone well off our allotted estimated time yeah but for a workshop because it is set there's fewer items I think we can make it work any other comments okay so the motion is only for workshops to have an agenda that has
a appropriate timing sequence correct yes labeled estimated if if the top of that yeah that would be an amendment and um I wouldn't agree with that Amendment as a friendly Amendment if we're going to have a timed item it's a timed item we're telling the public this is what time we are starting this item no that's so so I'm just saying that I wouldn't agree to that as a friendly Amendment but you could make that as an amendment and we'd have to second it and vote on it and all those good things yeah the um I don't believe that we can do it without designating it as estimated because we have no enforcement otherwise I mean we don't have any important way to enforce a timed uh uh you know the the thing will be
an hour the presentation will be an hour and a half well if we get involved with asking questions of the presenters and we are now at um an hour and 45 minutes instead of an hour and 30 minutes we can't stop the workshop presentation and say you'll you'll have to wait until the end of the meeting now to finish no we go on and finish our workshop and and by just the fact of doing that we have lost our times that are on that outside edge in red we have no way of enforcing it so my my impression from superintendent Staley was that we could actually follow a timed agenda for workshops because of the nature of the workshops and having a fixed time for presentations and accounting for time for questions and perhaps we
as a board stick to our timeline and to say if we have extra questions we'll save those for later we can ask those questions later if we move the asking questions later then we're asking all of our presenters to wait until we finish the rest of our agenda and that's not going to work any other comments or discussion um sure um to your point I think we could ask I mean especially if it's a workshop presenter politely and I love you guys uh presenters for workshops of staff and I if we're trying to prioritize the needs of parents who come and speak in a particular item I'd much rather prioritize them I just have to stay a little bit later to finish up what we're doing I think this could be um used to squelch
public comment because you could always schedule something that you didn't want anyone questioning you or bothering you about what you were going to do you could schedule it right before a timed item that you knew was going to take a long time can you clarify put on the agenda you could say create a timed item for seven o'clock right and then you could put as the third item on the agenda that evening something that you wanted to sabotage if you were in charge of the agenda not that Dr Kaiser would ever want to do that but you could create problems for for a certain agenda item by putting it on the agenda you know before a timed item um superintendent Staley so I I can see that there's going to be a lot of discussion
that we still need to have on this topic and my concern is that we do have students here tonight and so I'm wondering if at the will of the board we can move this item to maybe when we're talking about board policies just this 4.6 so that we can get our students up and and present I erroneously told them that they would be right at the top of the agenda and so I do feel bad about keeping our kids waiting I think that's a perfect example being expressed and I just want to address by saying just address that that concern by saying that we also have the ability to extend public comment time so we could vote to extend public comment um but but we can continue this discussion later on I just wanted to
at least say say that much well my concern is it's five minutes to seven and we had a student presentation correct at 6 25 so they've already been on hold for a while yes in alignment with what uh superintendent Haley just said um May I make a motion to uh table this until we get to the board bylaws discussion okay can I get a second I'll second that all right so we have a motion to table uh and a second uh any very brief discussion I I don't see where you're tabling it too Lord by loss so 10.3.1 11.34.3.1 I missed the whole pager look at that all right 11.3.1 thank you okay I'm not fighting it but that's my fault thank you okay all those in favor signify Brian racing hands thank you okay
only okay oh you're not voting yet oh okay okay thank you for one all right so student reports you've been so patient well first of all thank you to little Chico Creek for being here and for your patience and you are seeing government in action so I'd like to invite principal Kristen schalk to the podium to uh tell us what we're going to hear thank you and good evening I'm here to tell you quite briefly about a battle of his ex which is an acronym for balance auditory Vision exercises and these exercises use sandbags and racquetballs and they increase in difficulty they help students who struggle with visual tracking Focus memory auditory skills impulsivity balance anxiety and emotional regulation Bell of his exercises can be done individually with Partners or in a group they Foster
cooperation peer teaching and Leadership skills their purposeful rhythmical and repetitive repetitive movements enhance learning and regulate the brain so that it's ready and able to learn and over the summer little Chico Creek staff had a two-day 17-hour professional development Series where we had intensive training in Bella vizx exercises anticipating our students coming back with some amount some degree of Trauma from the past few years so with me I have brought four of our students and I would like them to come up and introduce themselves and then they will demonstrate quite briefly for you [Applause] I'm Cruz banegas My Name is Izzy Cartwright my name is Madison Boyd my name is Carter Boyd foreign any questions you uh do realize you're gonna dog drive my dogs crazy with the ball bounce you know that right how
long wait a minute how long did you guys do it I mean you know practice a little bit every day five minutes ten what 10 minutes 10 5 10 15 minutes cool what do you how do you notice it makes you feel over because like it keeps my mind off a lot of stuff A Little Closer it made me feel calmer I've been watching can you share um has it helped your academics at all there was somebody in the audience were you at wanting to ask a question we don't I think it would be an interesting addition to the process the the tenants that followed that was the auditory piece and the Rhythm and so really when they when they're not nervous they can do their rebounds and it's all in sync and so that
Rhythm keeps them going and it keeps them focused um I'm not sure what the edition of Music would do they haven't tried that yet it didn't come up in our training but we can also do it like in syncs and like it has a rhythm to it yeah okay thank you so much hey thank you guys thank you for staying with us and sharing and I may go try that I'm sorry that our Rhythm was a little bit off so that you guys were late I didn't know we were gonna do that but so I'm going to move right on into the superintendent's report and this is the time when we like to honor some staff that are doing some exemplary work out at our school so at this point I would like to invite
Emily Mullins to come to the podium Emily is our principal at Hooker Oak Elementary School [Applause] good evening thank you well I'm delighted to be here tonight I have two staff members with me that I would like to recognize with the superintendent's award and I'm going to start with the classified so it is with great pleasure that I present the classified superintendent's award to Jess smiley [Applause] Jess was hard as our health assistant at Hooker Oak School in February 2020. as you can imagine she had little time to learn the ropes of her new position and a new school before the world came to a screeching halt for the remainder of the 2019-2020 school year while the students were doing distance learning just came into the office a few days a week it was during
that time that I really got to know her and experience her witty sense of humor and her positive attitude when 2020 2021 began and we were all back to work full time Jess amazed me with her work ethic and her ability to learn under pressure as well as to adapt to the constantly changing landscape of covet 19. during our many shifts and pivots last school year she was instrumental in communicating with families and supporting our office staff with whatever it was that needed to be done this current school year Jess has not only been able to keep up with the demands of her position now that all of our students are back full-time but she has also taken on a growing number of responsibilities as our coveted site lead as things constantly change and evolve
Jess stays up to date and she maintains a positive attitude it is such a blessing to have someone of her caliber in such an important position I obviously think Jess is amazing but I went ahead and reached out to some of our staff to see what they think here are some of their responses Jess is patient and she has the best sense of humor Beth geise I've had the pleasure of seeing Jess in action on multiple occasions she makes anyone who enters her office feels special she cares for our students like they're her own children and she has even taken care of some staff members we are so grateful for Jess she is such a valuable member of our school family Melinda Hildebrandt Jess is so positive and awesome she shows up for the students
and her colleagues in a real way she can handle any challenge thrown her way we are so lucky to have her at Hooker Oak School Megan grudy this is just a small sample of some of the many reasons why Jess is so deserving of this award it is an honor to work with you every day at Hooker Oak thank you for all you do congratulations [Applause] you got competing camera angles here alrighty so next we have our certificated staff and I'd like to invite Carrie Jamison [Applause] so I have worked with many speech therapists during my years in education and few have been as outstanding as Carrie Jameson it is for this reason that I would like to recognize her as the recipient of our certificate in superintendent's award Carrie began working at Oak Grove
School at the start of the 2019 school year I was immediately impressed by her friendly demeanor her positive interactions with staff and students and her ability to manage a large caseload of both IEP and school-based speech students the first time I attended one of her IEPs I was impressed by her ability to explain speech assessment and share goals with families in a way that made them not only feel included in the IEP process but really help them to understand any of you who've been through an IEP can know that there's a lot of jargon and a lot of complications and she has a really uncanny way of making parents really understand what we're talking about she has a way of making everyone feel valued and feel that their opinion matters she never makes decisions without
seeking the input of all stakeholders and carefully weighing all of the pros and the cons when most people think of a speech therapist they think of someone who's working with students on pronunciation of speech zones Carrie's work with students goes far beyond the basics of speech zones she uses social stories to help students use language to advocate for themselves to make friends and to solve conflicts she is a master at creating visuals that support students in their Social Development she is often sought out as a resource to port to support students and she gladly does regardless of whether or not they are on her caseload or not I often see students skipping down the hallway with a smile on their face saying I have speech today with Miss Carey as a principal that fills my
heart with joy students don't see their speech sessions as something they have to do but it's something that they get to do I'm incredibly incredibly grateful to have Carrie Jamison on our hook rope team she truly makes our school a better place thank you Carrie and congratulations on this well-deserved award [Applause] thank you Dr Kaiser and that concludes my report I'm sorry uh all right so I really appreciate the recognition and the activities that are helping students and families so much in both cases so now we're open to announcement does anybody have an announcement all right uh so we moved to items from the floor so items from the floor are things that are not on the published agenda each speaker is limited to three minutes is there anyone that would like to speak or
an item from the floor so I do have four individuals who have signed up using the speaker card process which they'll be given priority the first is Gina backs okay good evening my name is Gina box and I have five kids I thank you for the opportunity been here um I would like to take this opportunity to request the use of metrics to end masks at chica schools as of today and according to the Butte County dashboard 54.49 percentage of the population has received one or more doses so why are we enforcing masks according to Dr prasa an associate professor for the University of San Francisco open quote the educational costs of facing covering is far better established than the benefit of the masks an article reading by Zach Schultz a senior political reporter from
PBS Wisconsins note that wearing masks as a requirement for in-person learning have been particularly challenging for students with special needs as an immigrant I know that much of language learning and comprehension is based on visual perception of facial body language the use of a mask delays comprehension and results in mispronunciation many people with ASD are highly sensitive to touch especially in the face wearing a mask involves many unpleasant Sensations for them I have an IEP kid who struggles with masks and as our past speaker says visuals supports learning since I've been involved with the boards and the meetings um I have found very interesting that all the boards and all the person the people representing other community always pay too much attention to communities of Interest immigrants and special kids but then your decisions are
affecting us negatively so I find that very interesting the same kids who we are supposed to protect and defend are the ones losing big time it is going to take years for these kids to be at the expected level of Education within our failed public school system since April 2020 we have learned young kids are not the primary divers of covet transmission and schools are not the center of a spread as I was dropping my kids at school they told me they forgot their masks and I told them that it was okay they say it was not okay and they were scared to get in trouble seriously a friend of mine who is Hispanic and she is Latina stop sending her little girl to school because her glasses would get foggy and she got frustrated
and didn't want to go to school anymore the American education system has turned into a system of restrictions in mandates parents should have the right to decide what is better best for our kids and citizens have the right to invalidate any laws deemed unconstitutional thank you thank you I forgot to announce so for our next speaker you have three minutes but that when you have 30 seconds left there'll be a yellow sign and then at the end of that time a red card you were fine I mean you were right on it our next speaker is Robert Keane good evening everybody my name is Robert Keane I've been working with the Chico Unified School District for the last five years my main job is a school bus driver and that's the subject that I'd like
to discuss today we have a new bus bus 57 just came out of the garage after it got delivered to our bus yard on Friday brand new bus looks really nice but I'd like to talk about the other end of the buses the buses that I want to talk about is for our kids that are the ones that need the most protection that is special needs I drive a type 2 bus this is a bus that is transporting kids that have needs where they are emotional a mental physical and they have needs that are very specific what I've found out of my five years driving is that it seems that there's a difference between the general education kids in their transportation and the special needs we have gotten new buses for the general education buses
and what I would like to point out is the special needs buses which one of them I drive are of a different age and different safety um class the bus that I drive was manufactured in May of 1992. it's coming up on 30 years the bus that I drive if you notice a school bus it has certain features that are required one of them that is most prevalent is when you stop at a school bus stop the red lights are flashing a stop sign comes out if you look at my bus it does not have a stop sign that comes out this is a danger meant to the students on the bus and myself the reason why most people when they're driving they see that sign that tells them to stop I had a kid
that I picked up this morning on West Sacramento taking him to Chico High I had two high school students in the bus I asked one of them to count the cars while I got the special needs students on the bus he counted seven cars that passed the school bus with the red flashing lights no stop sign it is against law to pass a school bus with lights flashing basically it is the same type of Tiff kit as if you read run a red light now another thing that I would like to point out is that our buses that we have for our special needs are of an older type bus and the newer buses they have what's called death which is diesel emissions fluid what that does is it makes the buses exhaust cleaner Robert
I'm sorry yeah your time is up okay um if you want to look there's the date um here's what it says this vehicle conforms to all applicable federal motor vehicles safety standards in effect in August of 1992. we are vast approaching 2022. all right thank you so much I really appreciate you coming I really appreciate your driving too all right uh Julie three is that now it's pronounced okay thank you hello there school board I thought it was actually in our 12th so this is fine a couple things on the communications I was just going to add that the one thing you all do that the other two bodies don't do is you broadcast on YouTube and I really find that I'm very convenient and so to your point about encouraging you know people to
come to the meetings I actually watch all of it on YouTube so I appreciate that a lot um I'm here to talk about planning for the vaccine mandate that we know is inevitably coming down the pike I've been following the Sacramento City Unified School District who had kind of gone ahead of Governor nuisance mandate on July 1 and it took them about three months to implement their January 1 February 1 implementation date when everybody over 12 is providing proof of vaccination so to me that kind of means that things are going to start rolling around probably March 1 so one suggestion I had was maybe on your agenda and I know you already talked about the agenda but is to replace that legislative piece with a health mandate or a vaccine policy something like that
so parents know that all the time they're going to see that on the agenda and here's something from you all about it but then the last piece is um tomorrow is the Nullification um holiday date and I want to just read really quick about the Nullification holiday tomorrow nullification is a legal theory that a state or person has a right to invalidate any laws denied unconstitutional with respect to the United States or state constitutions mad any that we be vaccinated for a virus that has a collective 99 survival rate with a drug that does not prevent infection or transmission violates the Constitutions of this state and Country we the people are not bound to comply with such laws we are within our human rights to nullify them as did our founding fathers the day America
was born at the Boston Tea Party December 16 1773. we have tried to reason with our government to no avail when reason fails nullification will prevail in preserving our freedom just as our forefathers said no taxation without representation we say no vaccination without justification thank you okay Catherine Posey and that's our last speaker that signed up okay gotcha good evening everyone I have my timer up here to make sure I stay within my three minutes um so this evening I invite you to consider ways you might respond to the frustration of many families and students over the continued Universal masking in our Chico schools and the fact that as Gina mentioned previously there are no metrics in place for California schools to end masking I recognize that you think you can't go against sustain their
policies and this isn't a complaint at all Blitz just brainstorm together so today marks day 636 of the coven pandemic if we're counting but here in Butte County actually this is a great thing we're looking at a downtrend in coveted cases and hospitalizations um so I'm going to have to skip some of that you can find it on the kova dashboard though but on October 24th there were 63 cases of covid-19 and ages 0 to 17. on November 21st there were 12. um so skipping ahead many states as you may or may not know have ended their school masking mandates some of them were giving dates in October November or December for their expiration some in January or February 2022 one example to point out the Michigan State Board of Education voted to allow individual
school districts to respond to the pandemic as they deem necessary which includes the authority to mandate masks or not I wanted to draw attention to a Washington Post article the risk you've probably heard this before that children is too low to justify the remaining restrictions they face somewhere between 0.1 and 1.9 percent of covid-19 infections in children result in hospitalizations and but recent studies suggest approximately 40 percent of those admissions were misclassified so jumping ahead um this is an interesting quote I wanted to read our kids May sometimes wonder how it is that they can Master entirely new fields of math in a single school year but the adults who run the entire world can't figure out that a .0007 percent risk is not worth worrying about okay so I share this information to connect
with the frustration of many families actually all over the state in relation to the their children wearing masks they're not agreeing that the masks are harmless in the fact that they see no end in sight I'd like to see Public Schools succeed here in Chico and I'd like to see students receiving the full benefit of in-person Education connecting in positive ways with their classmates teachers Administration and staff however that may not happen if you have a significant portion of your school families who decide to take their children out of the system because there's no end in sight to the masking so in light of that here's what I'm concluding with I would encourage you to intentionally clearly and wisely ask the state to develop the metrics to make masking optional in our schools our County
should have local control I know that that's not the way it is right now but at the moment Mark galey is simply saying mass will continue into 2022 he's provided no off-ramp adults have off ramps so I would encourage you in any way if you can do that thanks so much thank you at this time we do have about 10 minutes left in the time period so if there are speakers from the floor we would open it up to anyone from the floor at this point so if there was someone who wanted to speak for three minutes on an item that's not on the agenda that's the question okay I don't see anyone yeah I've seen none thank you oh in the back yeah you've already spoken I would request it was my understanding at
one time the board was going to ride with a bus driver at some time I would love to have somebody ride with one of our buses so you can experience what the students and the bus drivers go through I think that's an excellent idea and I'll I'll put that out to the board to see if anybody's interested thank you thank you Robert okay so um we will move ahead [Music] now we have our negotiations update which is still there let's be his last time on the agenda be the last time okay so um real real quickly with UTA we've been talking about a number of issues special education caseloads and class sizes we were talking about the long-term prospects of block schedule at the two high schools and we currently have it in place at
Chico high for the short term but we're talking about the possibilities long term and and formulating some parameters around that we're also talking about elementary prep time in order to reduce the immense drain on our sub pool for elementary prep time and and trying to figure out how we can do that best and then we're also talking about additional stipends for CTE which have grown uh considerably since we wrote the contract language many years ago because we have a number of Grants we built buildings with our CT program and our CTE programs which the board has supported over the years has grown considerably with regards to CSEA we continue to talk on Merit system rules and hiring mousse in order to increase pay for some hard to fill positions and then some issues regarding health
benefits so continue to have those conversations and we'll be meeting again right after the first of the year when would you like to add anything to that nope all right thank you short and sweet okay all right so we are now moving to the consent calendar does anyone wish to pull an item from the consent calendar all right seeing that one from the board oh okay I'm sorry uh Dr Kaiser it's not that I want yeah I have to pull them in order to comment I do believe um so I'd like to pull the number 10 number 10. okay and there's an FFA field trip number yes number 10 number eight and number ten okay thank you all right is there anyone else that wishes to pull an item is there anyone in the audience
that wanted to pull something from consent okay seeing none all right so may I have a motion then on the consent calendar I move approval of the items not pulled I'll second that okay and so our last vote was 5-0 so we can vote with a simple yes or no so all those in favor of the consent calendar with the two exceptions that would have been pulled please signify by saying aye aye aye aye all right thank you so it passes five to zero so now we move to item 10.8 which is the field trip request Chico Junior I mean Chico High School FFA yes thank you madam president um I don't have any um question regarding this what I have is for both 8 and 10 just to pull them to highlight what amazing
opportunities these field trips are providing for the students involved um in leadership skills in all kinds of um there was a quote in the uh the leadership skills uh that I wanted to highlight um develop leadership communication public speaking and teamwork skills some of the most valuable things that we can give our young people today and in number 10 and all of the other field trips actually I would include in this comment we are providing opportunities for our young people to excel in sports in number 10 the chico High School um made for excellence program uh uh again it it's not part of their everyday class work even though the semar the CTE programs I I just wanted to say thank you to the staff that are providing these extra opportunities by volunteering to take
on these extra positions that they are paid but they still have to sign up to do this extra work in the way of coaching or or teaching and I just want to say thank you to the staff for you know providing opportunities that our kids can't get any other way and I'm just wanting to say thank you okay skillsusa there it is I knew there was another one because the the PV skills USA group um which quite often places at the state level is uh also on there all right so would you like to make a motion oh I'm sorry yes I moved to approve um the two remaining items eight and ten all right second second that okay all right so um we have two items left to approve in the consent calendar all
those in favor all right all right all right thank you okay so that moves us to discussion action calendar ed services uh the All-Star parent program overview so Ted Sullivan good evening uh we're excited to share a little bit um some of the feedback we just received kind of in the middle of the pandemic was that it was really difficult for parents to connect with each other and kind of know just strategies and ways to support their students going with things happening so we have a bunch our Jamie McLaughlin our tosa with homeless liaison position has done a great job kind of facilitating moving ahead with an All-Star parent program so she's here to share a little bit and she's also brought some of the parents in to kind of talk about the program what
it looks like so I'm going to turn it over to Jamie and them and let them share a little bit and answer some questions for you guys okay um I actually prepared a little bit but I'm going to email you instead because I think what's more beneficial is to hear from the families that are part of our program and like I mentioned in the beginning we have a program in Spanish and a program in English for our families and I'm going to turn it over to one of our targeted case managers in a program from our Spanish okay buenas noches my number is good evening my name is Yesenia Avalos I have two students one actually Chico high school and one at Rosedale yeah I'm attending the highly capable kids classes my experience my experience
in this course has showed me to get to know myself better as a mother of two children and to identify my my strengths and weaknesses as a mother that I didn't know that I had felices thank you in attending uh and attending and getting to know more parents that feel the same fear in having adolescent children it has helped me to know that there are different ways to to raise and and help our children and that they can they can be they can have high expectations for their growth and that they have security and confidence in themselves so they can be happy and productive children so I like going to the classes because I can talk in confidence of how I feel as a as a parent about my insecurities about how I raise my
children and the best part is that I don't feel judged um guess I'm next I'm Jose Perez I do attend the class and the thing that I find beneficial of the class is that at 60 years old it's helped me recognize some of the things that I thought were normal and raising a child um not that I abused them or nothing like that but a lot of things I just didn't get and it helped me open up more um one of my wife's complaints is always I don't talk as much too much or on my communication skills so it's kind of helped me bring out some things on why I parent the way I do and um find you're not growing up in a different area you know we kind of raise kids differently they
have to be raised a little bit different and I'm finding those fears I don't have to bring him up here with me um listening to Other Stories it's a it's a real eye-opener yeah and and uh sometimes I stutter stuff like if I get mixed up um so so it's helped me just really really understand a thing too uh in this class I think it it would be good even to have uh just stretch this out to um uh uh young adolescent parents and have them understand that there's help out there so um my my wife is shy so she don't another thing is you know they they feed us so so so so so that that means once a week I don't have to eat my wife's food um I'm just joking so it
is a great class and it's I'm glad the district you know made it happen all right thank you hello I am Roshana Pollard this is RJ Pollard and Langston Pollard and we were also in the All-Star program um this kind of reminds us of how they used to have parent Cafe night which they no longer do because of the uh because of covid um but we we all still wear our masks and stuff like that so this reminds me of this um and it was very very awesome and we all got together and we all unplugged from our devices and we all just sat and talked and ate as a family and we got to meet new families and it was once a week and it was very awesome and we actually looked forward to
going every single Wednesday um and there there is a break now and then they will be starting up again sometime in January which we will be attending as well again and it was just a great time for us to meet new families and to go ahead and enjoy our families as well without having any devices or anything like that so we love the All-Star program and it was very beneficial to us and we appreciate it all right thank you I'm so sorry we had your children sitting through such a lengthy meeting and thank you so much kids for staying here and now you can go home and put your jammies on I I do before we move on hello just making sure everybody's awake I do want to make sure we thank Jamie McLaughlin Jamie
is our homeless Foster youth coordinator have she made all this happen we did not have this before Jamie arriving and so it was certainly a goal and she put our vision into action and I think that parents agree we are very fortunate to have her thank you with your permission I would like to excuse the families that have been here is that okay thank you thank you good night thank you guys all of you for hanging in there it's a family group I just would like to give a little brief overview of what we what we've done we like I said before it's a 13-week session we're halfway through and we service over 40 families and we have the two programs one in the morning and one in the in the evening we provide um
food and child care in the evening time and we would and food in the morning time however The Mamas their kids are in school so they enjoyed to have a little break it we have a very diverse evening program we have moms and dads from quite a few different ethnic backgrounds and economic backgrounds so it is quite diverse so our conversations tend to go beyond when our time so we actually got permission to extend our program at night time by another half an hour in extend child care services because the parents wanted more time to collaborate and learn and so I I am grateful for the board and for our Administration for allowing us to be able to do that we do have plans to expand our program and we are off to a great
start I do want to invite you date yet to be determined we will be having a graduation ceremony for all of our families and it'll be a dinner and graduation ceremony and we would love to for you guys to attend if you can and we will purposely not put it on a Wednesday night so that way you guys can come do you guys have any questions while I'm here um the program um when you developed it did you have a certain number of capacity um for for how many families would be served this first round yes we we because of covid we try to keep it small and we're learning the program um it's actually a program called um resilience kids re and it's raising highly capable kids and it's a curriculum that was already
been developed so I cannot take credit for developing the curriculum just for organizing it and bringing it to our our community and getting the families there we purposely kept it smaller because of covid and and given us an opportunity to learn and the purpose of it is to help like the families that you've seen today to train and be able to help provide the program in the future with our support so they're in their first year and they and they get the opportunity to train with us and come back next year and be part of the training process and so and so it's it's currently serving 40 families you said yes and um so was there capacity to serve more than that this first time around there is um we actually have the opportunity to
have more at our shelters for our homeless families however with what's going on with their reorganization and people are moving around so we're kind of caught up in that but it was offered and it is still offered to them we're just working on the logistics of getting the families there and for this year that will complete our expansion and that has been plenty awesome thank you um before you go sorry I just want to express my total support for this program I love this program I love that it's working I'm really excited thank you so much for you were trying to you know say you didn't make the the curriculum but putting it together is a huge feat and it's really one of the most valuable new programs I've seen in a long time um
if we can do anything to support you in the future as we scale it up please ring into us and let us know all right and we did have another parent that was going to present tonight however the father got into a car accident and and then one of the families came and it's actually her husband's birthday so that's just I just wanted to let you know how much they really appreciate this program to be able to to stay and the kids I did offer them the ability to speak but they were all shy thank you thank you next time we'll have to have ice cream stickers or something thank you all right that was informational only so we're moving to 11 2 which is discussion action approval of the resolution number 1562-21 the Chico
Unified District and Department California Department of Education preschool continued funding application so we're back to dead we are I'm just back before you seeking your approval to keep our relationship with CDE running our state-funded preschools and kind of keep that relationship intact and uh hopefully someday online we'll be able to expand also we haven't had that opportunity yet but the programs are running are all running at very full capacity we actually have a waiting list so we're just excuse me we're just kind of waiting for opportunities to expand and of course we'll start running some facility issues with that also but long story short we're looking for your blessing approval to keep that relationship intact and keep our state funded preschools operating I move approval of this item I'll second that motion all right so
I have a motion and a second prove the continuing funding application it's resolution 1560. it's just our agreement that you know the state knows that you are supportive of this and wanted to keep moving on you know lets the state just keep that funding in line for us all right any other discussion um I just wanted to really quick remind the board that we do have order to follow so make sure that we're following our points of order even though we know that we are falling a little bit behind um so uh yeah just wanted to comment on that there's anyone in the audience who have a comment all right so we've had a motion in a second discussion all those in favor signify by saying aye aye thank you very much thank you okay
so the educator Effectiveness block grant is 10 excuse me 11.3 and that's Tina King good evening I am back with the educator Effectiveness block grant that would give Chico Unified 3.1 million dollars through the school year 2025-26. so as you saw last time we have been able to sustain through those years with this plan the counseling and the mtss coordinator positions so those were approved as a reminder approved by the board back in March and I know there was concern about keeping those going forward especially counseling and this grant has enabled us to do that so I'm here for your action tonight all right so does anyone have any questions or comments they wouldn't want to ask all right does anyone in the audience have any questions or comments all right so seeing none I
I have I'm sorry I have a question what are the two positions mtss coordinator and and to continue with our counselors say that again the additional counselors that were added in for this year any other questions may I have a motion then yes I move approval of this item thank you okay motions by Tom Lando I'll second that motion and I'd like to comment all right that um I'm really glad we sought this grant to hopefully extend our ability to fund all of the things we put into place earlier this year when we voted you know for for funding our priorities and thank you very much for your work Tina on getting this secured and before us thank you the ed services team felt very strongly as you did about any way we could sustain
some of those great things we would like to do that all right so any further comments any comments from the audience okay so all those in favor of the educator Effectiveness block grant signify by saying aye aye aye okay pass this five to nothing Now we move to Business Services probably the densest report I've ever had to struggle through so this is resolution number 1563-21 approving the environmental impact report for the Inspire charter school edition to the Canyon View High School project Julie good evening thank you for your time this is actually the addendum to the environmental impact report the initial or um impact report was reviewed and approved in 2002 it was then amended again in 2014. and now we're asking the board to approve the third amendment because we are adding Inspire School
of Arts and Sciences to the plan for the property John if you could bring up the first slide just real briefly I know that not everyone on the board has been as involved with the Canyon View Property over the years so I just wanted to show you this outlined in yellow is the 50 acre property that the district owns on Bruce road and it was purchased been planning for a new Comprehensive High School in Chico the area that shaded a little bit darker kind of we call it the flag is a seven acre portion of the property that the board previously had approved for inspire School of Arts and Sciences to move to as part of the master plan approval um I know that you are all provided the amendment it is very lengthy um
I did re receive some feedback yesterday um a couple of three typographical errors were noted that are being corrected and there was also a question regarding the mitigation and monitoring plan the mitigation and monitoring plan is part of the original eir that was approved back in 2002 as you all may be aware there are wetlands habitat out in this area of town that is protected and that's why this mm-51 for protecting biological resources is included in this mitigation and monitoring plan we've actually already implemented this portion of the plan when we did grading about three years ago I think we did a large grading and drainage project on the property and we we utilized this monitoring system where we would go out and we fenced off all of the environmentally sensitive areas so to ensure
that they aren't impacted by Construction in any way and this mitigation measure will also make sure that we don't um create drainage that impacts those environmentally sensitive areas during construction so I know that was a question that was raised by the board upon review of the document are there any other questions that I can help to answer tonight so it was noted concerned about waste removal and water quality I didn't remember a discussion of this site having a septic connection or a sewer connection yes it will have sewer connection to the city city sewer correct okay if you want to go to the next slide there John this is the original conceptual plan for Canyon View High School on the property and as you can see that flag portion although it's oriented a little bit
different used to show that it was going to be sport Fields like quartz and it also had a drainage area this is kind of the lowest elevation in the area so all of the the storm water drains that direction and into the city stormwater collection at the the furthest south west corner of the property um back when this concept was drawn we would have had above ground water retention like a pool a pond that the stormwater would run to and now things are being done a little differently where we will be putting that under the parking lot so it will actually be subsurface and water will collect there be slowed down able for solids in that water to settle out and then slowly go into the storm drain system instead of all impacting it at
one time the goal is to keep as much storm water on site as possible now if you can go to the very last slide just wanted to show you we did change the concept of the future Canyon View High School site because of the work that the city will be doing on Bruce Road they didn't desire to have a parking lot off of Bruce road because it's going to be it's going to have faster speeds that are safe to have turn offs on and it also shows that highlighted in yellow the portion of the property that will be for inspire are there any more questions that I can answer yes I mean um thank you Julie you mentioned the um the widening of Bruce Road and I agree that that that makes a traffic issue
did we change our exit from our property to a a different exit Point other than Bruce Road how did we accommodate that traffic issue so the front of the school I'm just going to go point to real quickly is Webster Road which actually doesn't go through yet as part of that housing project called Stonegate Webster Road will be constructed so the school will actually face Webster and that will be its main Frontage where visitors and teachers will have parking lots off of Webster and then the student parking is over on the opposite side which is Rayleigh Boulevard ah what about the uh entrance to in the Inspire site Inspire will also have an entrance off of Rayleigh if you uh I'll Point again okay okay yeah all right so Fremont Street will be an entrance
and exit as well as that roadway going out onto Rayleigh any other questions any questions from the audience um I was just impressed with the density and the complexity of the environmental impact report is quite uh quite in depth yes I think I'm sorry point of order we definitely need to ask about public comment right and and call for emotion we should be waiting for our president to call for a motion please okay I didn't ask for public comment so now I'll call for a motion yes thank you I move the approval of resolution under number 1563-21 second all right thank you Matt so we have a motion and a second any further discussion or questions on resolution 1563-21 all right so I'll call for a vote all those in favor say aye hi okay
five to nothing thank you Julie uh and whoever again whoever did this was extremely thorough thank you pardon thank you yes so you're up again for number two Pleasant Valley High School engineering design and Manufacturing product development CTE projects we're supposed to get bits correct yes we received bids on December 9th this is the fourth and fifth CTE projects and final projects at Pleasant Valley High School that we have in the in the works right now um we received three very competitive bids the first bid was from Bobo construction at four million four hundred and seventy eight thousand the second bid was Geno construction from here in Chico four million 250 921 and the lowest responsive bidder was Slater and Son also from here in Chico at four million twenty one thousand one eighty three
so they're all really close and we had good competition so we're very pleased with those bids and we're here tonight to request that the board authorized authorize us to enter contract with Slater and Sun that bid amount is within the budget all right any questions um I I don't know if I'm just not seeing it if I missed something but is there was there the numbers you just you just like gave us is there something for me to actually look at that no there isn't because the board agenda was due before it did okay so the information wasn't available can you remind me who the top two yes Bobo construction was the low or was the lowest oh Geno construction was second and Slater and sun was lowest gotcha you can I think I got
confused with the order and then the just the numbers and yeah that's true and so Slater was the lowest and their local and and that's who you're recommending yes thank you all right any other questions okay uh may I have a motion then please uh I move approval of the staff recommendation to enter into an agreement with Slater and Sun based on their successful bid discussion all right all those in favor signify by saying aye aye all right five to nothing thank you thank you so Julie you can't run anywhere correct no yes I guess you can't yeah well now we have Jacqueline [Music] I'm not okay I thought John promised me it wouldn't happen again that's the third time there we go sorry I'm just gonna use gems okay Jacqueline we're talking about the
financial update of the nutrition services program yes I want to bring before um you this evening there's there's a PDF John if you can launch that on this agenda item um Vincent Sarah who runs our nutrition services program and I've been talking a lot over the last couple months and he is seeing claims from a financial perspective that he has never seen in his tenure here at Chico Unified um the governor as part of his budget this year implemented meals for all for all kids so regardless of your economic status of your family's economic status you can participate in our breakfast and lunch program and so what I wanted to show was the volume of meals that have drastically increased in particular at the breakfast level this year so if you want to compare last
year to the current year we have the we have through November obviously is the royal blue color and you can see that it is substantially jumped for our breakfast meal counts we do have it at several of our schools a second chance breakfast which allows kids at you know 9 9 30 to be able to participate in that so you can see that that large jump so we're seeing meal counseling we've never seen before and more importantly those kids are eating right who maybe didn't have the chance before didn't know about it there's no paperwork related to this every kid is served it's as easy as that so I want to just bring that forth to the board tonight um and I'll show you the lunch counts as well they are higher they're not quite
as high as what we're seeing on the breakfast side as far as growth is concerned but we're still seeing more and more kids eating eating in our school lunch program and I bring this up because the next agenda item is our budget and with these increased meal counts and a slightly higher reimbursement rate from the state we have a zero contribution to the nutrition services program which is amazing because when we presented in June it was about eight hundred thousand dollars that was coming over from the unrestricted side of the general fund into our nutrition program and that's been eliminated so I thought it was really vital to bring this forth on two fronts one on the financial front but more importantly our kids are eating and they're participating in our program and I think
it speaks volumes events in his team comments from from schools especially the later breakfast at the start that the change in attentiveness and the lack of discipline issues because the kids have gotten a chance to eat when they begin to get hungry at 9 30 10 o'clock it is just a noticed and the the impact on the kids is is wonderful I also uh have uh grandkids that are participating in the second breakfast and it is pretty amazing [Music] can't finish what they have for breakfast at home if they can go to school and have a second one it's because it's too early yeah wow we're too rushed or whatever um but the the thing that really really struck me is the total number of meals that kids are getting that we are providing it's
just staggering and Incredibly I think helpful to our whole community and in case you haven't had the opportunity Vince just step forward so this is Vincent Cerro he's in charge of nutrition services if you haven't had the opportunity to meet him please do so I try not to inflate his head too much but this is pretty remarkable pretty remarkable and I would like to say that our nutrition services program is one of those programs that has had struggles getting Staffing and yet Vince and his team are able to pull this off a lot of extra work I know but it's been commendable as well to still make it happen for our kids yeah they're extremely positive workers I mean I've seen families coming with you know like a stroller kid that's obviously not in school
the parent and two other kids walking but they're all coming together food really positive I think it's a remarkable to seeing it graphically thinking back about how our students were going without food and and and now they're being fed and it makes a big difference and you know looking back on those last four or five years wondering you know what other impacts could we have made even greater and those times if we were able to feed them and just the importance of continuing this to the greatest capacity thanks for all you do events uh Tom thanks two things one it was mentioned the correlation between food breakfast especially and discipline issues I would love it if it was possible to gather some you know site-by-site data on the increase in breakfast served and any uh
change in the number of discipline issues I think it'd be really valuable better to have not just for us but for other programs as well my other comment was man Vince your passion for feeding our kids I love it every time you hear I'm going to say thank you because it just it's so good thank you so much for doing this I had a conversation with Vince when uh at the bakery and um he was so distressed because he had families at that point that weren't paying and you know their kids were eating and how what was he going to do and how was he going to get the money in that's such a heart-rendering situation to be in so I really really appreciate that the governor has recognized this as a critical need critical
need all right so uh can I have a motion no I'm sorry you already did it okay I didn't put your name down little Tom I was like what oh informational only oh this is just to give you a fat head what the heck well I'm happy to be able to do that thank you okay so now we have the approval of the first interim budget and you have somebody new to it introduce don't you yes all right this is Cherise for Ali she's our new director of fiscal Services very good so John can you bring up the presentation for the next board agenda item please okay so we're here tonight to present the first interim budget this is the second time we've come to you at the 2122 budget um oh you can go
to the next Slide John thank you um our original budget was presented last spring first interim allows us to evaluate where we are landing after the school year started Staffing is in place programs are running Etc so the major themes tonight average daily attendance hold harmless provision for 21.22 the effect of covid-19 on attendance percentages and projected enrollment covid relief funding and persiansters annual pension costs okay so this slide has a lot of numbers on it it's something that you guys have seen before just to draw your attention to some things um if you look at the First Column enrollment if you take a look at between 1920 and we are estimating that we'll be down 269 kids then if you look at the next column p2ada that's average daily attendance that's where we're actually
funded we're estimating that we'll be down 632 Ada so why would that be well the reason is typically um for Ada projections we estimate that we would be at about 95.5 percent of enrolled kids attending every day if you look at 2122 we're estimating 92.6 this year and that's because we've had a lot of kids out because of quarantine also parents are just being really diligent about keeping their kids home when they're sick so this is our best estimate right now next slide oops there we go okay so this is a graphical look at this this is um actual Ada versus funded Ada um if you recall we're funded on the better of the current year or the prior year the whole harmless provision is why you're seeing in that 2122 column that we have
we're being funded still at that 11 8 30 Ada from two years ago next year 22 23 will be funded on the better of 21 22 or 22 23. so at this point we are estimating that there will be kind of a funding cliff all right next slide next Slide John thanks sorry um okay this is a slide that you guys haven't seen before this is just a really basic summary of our covid-19 relief dollars these are restricted dollars um they're made available by the government to prepare for respond to and prevent the spread of coven 19. we have to you know use those principles for everything that we spend this money on so we just kind of wanted to show you the total allocation that we had was 60 million we had very few
expenditures 1920 the funding was really new then 21 2021 we spent around 12 million 21 22 17 is about what we'll be spending and I just wanted to tell you some of the things the highlights that we've spent this money on um extra counseling tutoring reading teachers at elementary sites block scheduling furniture for social distancing PPE personal protective equipment HVAC filtration technology purchases Chromebooks laptops viewsonics and we didn't have a really big summer learning program over the summer so um yes that 30.9 million that's remaining that those dollars have time limits for spending right yes and it just depends on which Grant they're coming from right we're looking to spend into the 23-24 fiscal year okay and then I have one more question and this is actually more like a this has come up a
few times and I've never asked but um on the previous slide with this graph I just have a request and you don't actually have to do it sure um this is for everybody in financing but um I would like to just see um a preview slide that shows these bar graphs starting at zero and then zooming into this because it looks like you know when you if you for the layperson who doesn't read data a lot it looks like we've lost half of our students unless you start to really look at it yes we discussed that before I think so I think that's a change we can look into okay certainly just a image image wise thing definitely thanks and um we will be bringing a more detailed report on the covid spending and planning
um early next year so um sit and Cherise will be up good evening board so just some major assumptions that we've taken into consideration when building this first interim budget so the local control funding formula is where we get most of our unrestricted funds from um that is it's based on the state adopted budget and the state estimated that we would have a cola of 5.07 so that was what they gave us in the fall so all of our lcff calculations are based on that cross of living adjustment um we also use our Ada you'll hear that a lot average daily attendance Marie addressed that in the previous slide and the as she um spoke about before uh the number we're using for this year for the 2122 school year is that 11 830. so
that's our funded Ada another number that we use when we're doing these calculations is the unduplicated students these are identities identified subgroups and that percentage is 52.94 those subgroups include English Learners low-income and Foster students and this number has gone up by about 2.7 percent I'll address that in one of the later slides since we did the 45-day budget one of the other things that we use when we do this calculation is salaries and benefits so we build our vacancies and salaries and base benefits estimates based on what we had in the system as of November 1st yeah um sorry on the previous slide um I don't know why I'm not I don't understand but um what is the 52.94 a percent of that's our unduplicated percentage of students so that includes all of our
English Learners Foster and low income I understand so they are but I don't understand what is a percentage of of the total population of students okay and so that falls into this for budgeting purposes yes so that's one of the numbers that the state uses when they calculate our local Patrol funding formula so we have our supplementary Grant is based on that unduplicated percentage okay thank you yeah you're welcome okay so now we're taking a look at the income statement that was built based on our budget so that First Column is your unrestricted dollars in the general fund the second column is your restricted dollars so those are grants like all the covid money that Marie was speaking about CTE grants federal grants like Title One those are all the restricted dollars and then the
final column there's your total so unrestricted dollars that's primarily our local control funding formula I spoke about before we are estimating that on the unrestricted side that we're going to have a positive change in fund balance of 1.4 million dollars on the restricted side we believe that we're going to have a 5.2 million dollar deficit this number is a little tricky because they're all self-balancing all the grant funds that are in that restricted side but this takes into consideration carryover and dollars like that so we're not actually going to be spending down cash because like I said all those are restricted grants okay so this pie chart shows our unrestricted and restricted expenditures in the general fund so Chico Unified we're in the people business so most of our funds in the general fund are
spent on salaries and benefits so you'll notice that those three green parts of the pie chart they all add up to 80 of our total expenditures and that's all of our staffing that we have across the district one of the things that I had noticed was the uh jump in the amount for books and supplies it seemed to be distinctive and different well that could have been because of the cares dollars it could be because of the covid funding because we have a lot of supplies that we've been purchasing with those covid funds I think I was misled because it said books and I was like no that's all of our supplies so that's equipment that we've purchased anything that is physical items that would be included in that supplies budget so it could be
books it could be library books could be curriculum tangible books as well as supplies that are consumable within about a year okay okay so yes salaries and benefits expenses eighty percent of total expenses due in part to covid relief funding and you talked about this earlier I think you just mentioned that what we voted for on on earlier too but we have some added positions is what you're referring to this kind of came about as a result of that's correct the stuff increases that we've had with all those carriage dollars and other coveted funding yes any sense from the hip of what the percentage would be without that I'm on a typical year I'm not sure I want to say it's about 75 percent though our our general fund tends to be primarily spent on
salaries and benefits yeah low to mid 70s is pretty typical so 80 is high because of the additional positions with the coveted relief dollars thanks yeah okay so this next chart is similar to the last one but this is just talking about unrestricted expenditures so that's primarily that local control funding formula that I spoke about before it also includes our special ed contribution and we include that which it also includes all of our Sellers and benefits that we pay for our special ed program as well so that's a part of our restricted funds but we do contribute to the special ed program on the restricted side out of our general fund to fund that program so in this graph you'll notice that the salaries and benefits have increased if you include that special ed contribution
so it goes up to about 88 of the unrestricted yes I have a question because um I'm used to asking the question about special educations um um encroachment and how much is coming out of our general fund beyond what we're funded for special education and I can't compute the pie chart into that comparison the contributions about 17.2 million and I'll actually address that in the next slide okay yeah hopefully that helped okay so this slide talks about all of our other financing sources uses and contributions um in the general fund we have transfers in that come from our RDA pass-through revenues those are primarily used for restricted routine maintenance and that amount is going to be 3.5 million is what we're estimating that at this point developer fees admin support that comes from our developer
fee funds and that's three percent of the amount of fees that we're expecting to collect that amount we're estimating to be about ninety thousand dollars this year as Jacqueline spoke about we usually have a transfer out a contribution to our general to our nutrition services fund we don't have any transfers out this year out of the general fund into any other funds and that's because of the program that Vince is running right now so you want to make him do something sure okay and then the contributions to restricted programs Eileen as I spoke about that special ed amount is right there at the top so it's 17 about 17.2 million dollars so that's the 17.2 is above and beyond that's correct okay yes that's the amount that Chico Unified is contributing to the special ed
program fun continues I mean that funding level just continues to balloon the good news uh that was reported at our csba conference is that included in the buildback better bill that hasn't been passed yet there is a significant increase to special education funding right noting that it hasn't been passed yet yes um I would be interested to know um because I don't have that frame of reference assignment have not been observing the budget very long enough to see it ballooning right um to see how that translates into our number of caseloads because I I think that we're at a higher caseload right now too and that would also make sense why we're spending more that's correct the special ed program has definitely grown over the last few years for sure yeah at some point and
actually maybe maybe part of the workshop to see that comparison about you know how much is being spent out of our general fund per case load um and and maybe that will give us a better idea of how the spending is taking place I'd be interested at least just to see it okay so there is a special ed Workshop in the spring and that that's the exact data that we'll bring forward so we call it the people count the challenge I think that chica unified has is overall our district is declining an enrollment but our special ed enrollment is increasing so it is a challenge for us um but we will see so what we'll see is is our graft the the SKU will shift um and it'll make it look like our special expenditures
are ballooning even more when actually it's just that the population designation is is skewed so it's all it's all good data so you'll be seeing that data in the spring okay um so the other contributions we have to restrict Ed general fund expenditures so that amount we're estimating to be 5.2 almost 5.3 million this year and then the last one we have for contributions to restricted um it has to do with title III English learner this was related to our federal program monitoring that we had this fall it was determined that one of our prior year expenditures needed was not allowed and so we're basically reimbursing that restricted program out of the general fund okay so this is just a comparison of our 45-day update that we brought to you in August and then the
current budget that we're bringing to you tonight the first interim and the variants as I spoke about before that unduplicated people percentage went up by about 2.79 percent so that increased our local control funding formula by almost 400 000. um there are some other differences but the larger one that I wanted to bring to your attention was the expenditures this is due to those Staffing increases we talked about with the covid funds as well as the compensation increase that we gave across the board there were different percentages in each Union but it equals about three million dollars between those three lines the certificated salaries the classified salaries and employee benefits but you'll notice that in the first interim we still have a change in fund balance of positive amount so that's why we felt that
it was appropriate to do the compensation increase yes so I noticed in a very thick budget thing that we are it wasn't clear to me we are paying the County Board of Ed Butte County more it seemed to me and I wasn't sure for what is that striking a bell not off the top of my head but I think what you may be alluding to is um that we have students of residents of Chico Unified who attend our the lead program at the Boys and Girls Club that's run by bcoe and so how that works is bcoe reports attendance on behalf of Chico Unified because they there are students geographically so the cash from the state comes into Chico Unified and then we turn around and we pay Butte County Office of Ed to serve
those students so is that where the I think the term was tuition yes okay that makes sense because I was getting confused and then there was also a notification that we had our student enrollment being impacted by Charters a new Charter a chief came on this year as authorized under Chico Unified I don't believe it's accurate probably to say that our enrollment was drastically altered by a chief coming on under our authorization but they they are at the ninth Charter that's now authorized by Chico Unified effective July 1. yes core has continued to grow from a competition perspective but we don't authorize them but yes okay so at this point I'm going to turn it over to Jack OBS go ahead doc remember Dolly sorry I'm a master not a doctor no pretentious totally doing
it I've just been waiting for a chance to say that because because it's silly just wanted to cover it um the state revenues um decreased by 42 000 I'm you probably already said this but can you just remind me again why there was a little less than what we had expected um that I don't know off the top of my head that's going to be our Lottery Revenue that we receive related to Ada okay so as as we budget a decline in Ada then we receive less per pupil or per Ada in unrestricted Lottery dollars so that means in the day we the enrollment decline was more than what we had anticipated not so the enrollment the attendance percentage so at the 45 day update we didn't um I don't think we accurately forecasted the
impact of the quarantine and how that was going to impact our Ada okay so at the 40 day Mark what we had anticipated being our our not enrollment that was a misspeak on my part um but our our attendance um was was just under yeah or yeah it was off okay thanks all right so moving forward um the other piece to our budget every year is our multi-year projection really important for planning purposes so I'm noted earlier when we did the enrollment um there's also the Ada piece and so we are estimated to decline um 19 next year and 36 the following year again we're getting into that tricky part where our enrollment is decreasing significantly but because of this adjustment and attendance percentage the Ada impact is less because the hope is that next
year more kids attend more often so related to enrollment we'd have decreased certificate ft of six in 2223 and an additional 5 in 23 24. so when we look at these projections for planning purposes we certainly look at step and column for staff are changes in our stirs and Purge rates insurance and utility costs we're all seeing it in the fuel area as well the other piece we always take into account that we do have some savings related to retirees they tend to be at the higher end of the pay scale and we hire staff with less than 15 years experience coming in and right now the cola estimate it for 2223 is 2.48 and 23 24 it's 3.11 as of right now I'm sorry I have another early this is a very basic question
that I should know the answer to and I feel like I do but I think I might be wrong um when we're talking about our Ada funding um isn't it typically and I know that we are in some weird years um isn't it typically based on the prior year Ada so we're talking about next year's funding or am I misunderstanding that so school districts are funded on the greater of last year or current year okay so because we're declining we're basically funded on the prior year right so I'm thinking about next year um if we are working in the hope that we'll see a higher Ada next year because we'll have less quarantines and all those things that we'll be able to fund based on next year's Ada and not this year's possibly hopefully yeah
hopefully yes I am a person of Hope yes and we'll say hopefully um so here is the unrestricted side of our MIP what I really want to point out that was alluded to earlier is that funding Cliff so in the current year our revenue is 124 million and you can really see that drop down to 120.6 million and that's related to we don't have that hold harmless anymore and so we'll be funded on a lesser Ada amount but relatively speaking our expenditures are pretty comparable um in all three years and then with the cola increases back in 23 24 the revenue goes up to 124 again so it's almost current equal to the current year Revenue so it would be obviously as we said before change in fund balance of the current year 1.4 million
next year we would deficit spending 3.9 almost 4 million and then about 900 000 deficit spending in in the third year so I do want to point out we have very healthy reserves um currently in the in the current year we have 21 million that is undesignated fund balance at this point after the designations that the board has already approved and I'll speak to that in the next agenda item with the deficit spending we go to 17.8 and then 17.4 in that in that third year still very very healthy Reserves so the other piece that we're hoping to get legislative help with when the governor's budget comes out in January is the stirs and purrs impact so we did have a small reprieve on the stirs side last school year in 2021 the rate actually
went down which is kind of unheard of but it is continuing to grow so these are year-over-year numbers of values that we have to continue to add into our budget related to person stirs so as of right now in 2324 the rate for stirs is not changing it will stay at 19.1 which is why there's a big zero in that far right column so just want to point it out this is a real real dollar impact to our budget and one that we have to plan for every year going forward so cash flow is always important we always bring it up you can have a lot of fund balance but if you don't have cash in the bank you got a problem so there aren't any deferrals right now so we're good with that and
I will say that our healthy fund Reserve has helped keep a high cash balance year over year it's pretty cyclical of when the cash dips October November always our low months December spikes up because we get all our property taxes thank you for the taxpayers and then we usually have a small spike in April and May related to the taxes as well no concerns at this point so we are required to sort of self-certify this budget and it can be positive qualified or negative I'm happy to say that we are self-certifying as a positive budget going forward so we can make our obligations in the current year and the future years so pending board approval tonight we will submit this to bcoe tomorrow for their review so next steps anxiously waiting the governor's proposal in
mid-January so hopefully about a month away we are hoping for some stirs and purrs reprieve we're hoping for meals for all I'm going forward and there is talk about increasing the base rate that we're getting per Ada so hopefully those will come to fruition and as always kind of a feedback loop we're always continuing to evaluate the program and make sure that our expenditures align with our lcap goals our district prior priorities and that we are conscious of our deficit spending so after we come back from the holiday break Ed services and fiscal services will be actively starting to talk about the educational program for the 22-23 year and so we will be reviewing the coveted relief spending plan that was brought to the brought to the board last spring and we'll probably be bringing
that the February board meeting with some revisions based on the program that we'd like to implement in future years and then obviously very actively watching our enrollment we had our K registration so we'll continue to watch that we'll continue to watch our attendance percentage which is probably really really more important this year than any other year because it's going to probably determine our budget for next year from a funding perspective so we'll watch those two things in the early months of going forward before we come back in March with second interim is there any questions regarding the budget anybody have any questions um I I do have one um rtk does that count as enrollment for us and attendance yes from the state's perspective TK and K are the same so we do get Ada
for TK so as the universal TK is rolled out and more and more four-year-olds participate we do get Ada for those okay uh but I would assume not for the preschool no we do not that's a whole separate funding stream um based on that resolution that you passed earlier with Ted Sullivan okay okay all right so it's informational only okay no we do need a motion tonight from the board 21 22 first enter and it's been moved seconded all right so uh any questions or comments I have a comment yes please fantastic job thank you so much very thorough report presentation yeah you should feel that Jay welcome to the full you're running with some fast ponies over there okay uh what hey we may need to play the ponies you know things get rough
you know okay so um we have a motion a second any further comments all right all those in favor of approving the 24 and 21 22 first and around budget hi all right all right okay yes Madam president could I ask a quick question the governor's uh first budget comes out in January is is it April before we have uh our first update so the governor comes out with his proposal for the 22-23 year in mid-January then we come back to the board in March with the second interim budget for the current year and then the governor will come back in May called the May revise with kind of his final revisions related to tax revenue that's been collected and we use that as our basis for the next year and the legislature uses that
to pass the state budget all right so we move on to resolution 1565-21 committing fund balances and Jacqueline you're it again yeah so several years ago there was the state public school stabilization account was created at the state level it's essentially reserved for the state and part of that was if there are four criteria that are met the state is required to put a deposit into that account and according to all indications that's going to be met this year so the irony in that is that they the state is going to be putting money into this Reserve which triggers language that says school districts cannot have a reserve greater than 10 percent so of their assigned and unassigned So currently the district has 17 percent in our Reserve so one of the things that local
school boards can do is commit which is the most restrictive action that the board can take fund balance for specific purposes and so those dollars can only be spent on those specific purposes and then that those dollars are then taken out of the calculation for Reserve so before you this evening is a resolution for uh 14.5 million to commit for four different areas to basically help us to earmark those dollars for the challenges that we have ahead as well as get us underneath that 10 percent Reserve cap so what are the four I can certainly read those so I've got four million set aside for our stirs and pers volatility going forward five million dollars for enrollment and attendance volatility 1.5 million for the transitional kindergarten implementation and four million related to unexpected and increased
costs in our special education program this is basically a protective shield yeah correct yes all right thank you oh I didn't have a question I was just going to comment you know when when this thing passed the legislature the the idiocy of here's your money but if you save any of it we're going to take it away I just I mean the political deals that were made to set this up are Criminal I have a question end of comment I have the question of our presenter um so the decision to split the this money out the way that it has been split is based on previous circumstances or some kind of Trends or what is how are those dollars determined because person I mean actually I guess it'd be more discussion time for me to
say what I would personally feel but that yeah so that's my question these are identified as kind of very large areas of volatility right which is why you have fund balance to to be able to weather the storm and volatile time periods so in looking at these areas we know that transitional kindergarten is going to be fully implemented in the next four years and so we're running into facility challenges with that the Staffing with that so money was set aside in order to accommodate for that should we need to dip into our reserves and be able to fully run that program the stirs improves volatility again is if the state kicks in money that relieves us as the local Lea from our rates increasing if they don't do that our rates increase and then that
is part of our budget on an ongoing basis yeah I guess that was kind of my question is why we would put so much to stirs and purrs and maybe not as much to TK or even our special education program um I guess I'm just curious about the decision making process in in how that was allocated among the farm not I'm not I have no problem with the four criteria and I'm open to the board if the board wants discussion and wants to change the amounts we are certainly I guess I'm just wondering if I if I do want to like what was the process behind what how you came up with those numbers a lot of it was just estimation what's the impact and going out I look at I typically look at a
multi-year projection so I'm looking three years out and so if our steers and pers liability is one to 1.2 million dollars every year I took it out three years and rounded up and same with our special ed our increase typically is about a million dollars a year or so but with our person stirs rates going up and compensation increases and stuff just being more tenured um again took it three years and rounded up okay thank you that's what I was looking for my understanding is these are effectively still reserved by another name that we just earmarked them for specific categories so basically restricted funds now yeah so there will be when you see our financial statements they will be called committed fundance versus right now um basically they're all in unassigned other than the action
that the board has already taken like the additional two percent Reserve but they're still Yes they're still part of our Reserve they're just named something differently right Madam president might be recognized yes I think this looks like a level-headed responsible approach to all this um you know we've got sort of um one do you got your wants and your needs I think and you know respecting your stirs and pers volatility is is an as a need not a want you know it's it's a necessary planning thing um and then also in that category I think is planning for attendance and enrollment volatility and also in uh I think in that category maybe to a slightly lesser extent but you get into legal liability unexpected increased costs related to the special education program those are really
really important security for the district things you know and helping out with transitional kindergarten implementation is on our wants list compared to the other three things I think on this this little breakdown and you know it's also the one that we're spending the least money on in this metric and so I mean I think this just seems like a really responsible way to spend this money all right so uh there's no comments from the audience questions oh yes Kevin I just have a question if so like with the stirs volatility because we all know what's going to happen if if this gets earmarked for that and let's say the the stirs contribution goes down can the board re-earmarket for something else absolutely so this is the most restrictive way to earmark fund balance but as
it states in in the resolution the board takes action to commit these but the board has to take action to uncommit them in totality or to adjust them in any way so if that is the case then I would come back to the board taking off the stirs part should that be necessary but it would take board action to do that Kevin for all right so uh Madam president I'm sorry oh please come to the mic and give your name no hi I'm Jessica hunt and I am actually not speaking as the PTA rep I'm going to speak as a parent of special needs and one of the things I had to ask um that money that's being set aside cannot be used for Staffing yes absolutely so anything related to the special education program
okay because there's a desperate need for Staffing and I know you guys know that but I don't think everybody knows how bad it's impacting our kids um my kids have lost AIDS being transferred out to cover other one aid went to go teach at Marsh which is great and Diane knows all of this I just want to let you guys know that this it's it's serious there's a lot of transition in that for a lot of those kids transitions really difficult for them so you have an aide that's been with them for a couple months and then is gone they have to make new Trust Bridges with somebody else so thanks yeah we've struggled for quite some time to hire sufficient number of AIDS we have a lot of open positions we recently recently negotiated
with csca to increase the starting pay and that has turned around I mean as of today I know Diane was in interviews all day so it's turned around our our sum of our issues substantially so clear and Gem and all of his crew we did some work together to um speed up some processes by spreading some duties and we were able to move up interviews for AIDS we did interviews on Monday and today we interviewed 30 uh 28 people for 30 positions and so we filled all of those positions today and so those were those are positions that were open through covid because we didn't need people a lot of things fell away you know how hard it's been to get Staffing now and so I'm very excited thank you to your team that we
were able to fill many many positions also I want to shout out to Jay and Jim and our whole ed services team we've been working with Chico State yeah and um have done some job affairs with them and are starting to recruit directly through Chico State and so Jim and Jay in particular got that going so we're we're starting to look ahead we're starting to get excited about the possibilities I do have a question that you probably could answer Diane or or the cabinet um with so with this influx of applicants was it directly correlated with the fact that we increased the starting pay absolutely and what was can you share what that change was um so yeah I can so for example instructional AIDS we moved starting pay from step one to step four
and it's about two and a half dollars an hour more so we we started we were in competition with fast food at step one but we moved significantly above that and so we were able to get um right away significant numbers of applicants in immediately so it helped greatly that's awesome so it is good to note that that a little bit higher pay is going to fill our I also want to thank Diana and staff because that many interviews and successful hires and that a period of time is huge just huge and I do want to say that they were all qualified we went through the real process not Jay's process it and and they were all really highly qualified and we stole from some Charter Schools we stole from some agencies and some other
places that this is just what they wanted to do it was a really really good sorry Jason said that all right hahaha my boss sorry congratulate really that's just wonderful news that's announcement worthy day and come on I'll just throw out there too I mean it's important for special ed but we also did significant um applicant pool for our custodians too which is has been huge we've been chronic shortages of custodians so good good and all fronts but I want to say you see what you started by getting up and making a statement that's your reward thank you that's all of our Rewards you gave us a little kick okay so um resolution 1565-21 we have a motion and a second I'll move the adoption of presidential 15 65-21 all right okay all right any
other comments um I have a comment I'm just I I'm tempted to I don't know I guess I guess I'll just actually shut my mouth and just trust Jacqueline's judgment that's what I think all right so all those in favor say aye aye all right thank you Jacqueline saving our money okay so now we have the I'd like to make a point of privilege a point of privilege oh could we maybe take a five minute break please yeah thank you yeah all right five minute break enough we are back in session after uh slightly longer than five minute uh recess and we are back to the updated board bylaws and so um they are sequenced by being updated by being new and then again by being updated so um is there a particular policy that
anyone not a president I'm sorry point of order yes we had tabled our previous discussion regarding the agenda to this point right we did except in discussions with Eileen she's thought and I thought we had actually pass the two proposals that we had no what we tabled was the discussion about um the timed items for our board workshops okay yeah so we had moved that to this agenda item I always want to clarify if we're going to do if we're going to address that after the board by laws we didn't specify at which point so Kelly when you when you came to me there's not none of the quote unquote policies here address agendas no so what I had asked Dr Kaiser if they would consider going ahead and going through the updated board bylaws
the newborn policy and the updated board policies and then uh returned to the discussion about the agenda format and that way we can have staff and those that are waiting for to answer any questions you might have a board policies uh release them to go ahead and go okay and some of these reflect legal obligations the first one for example electronic communications that's the Brown act so they're extremely deliberate in the statements to make sure that everybody is aware and paying attention to the law so what I would suggest is how we have done the process in the past is that we ask if there are any of these board by laws policies that the board would like to pull and discuss further and then we would pull those and then pass the ones for
which there's no discussion or no concerns and then come back and go in numerical order for the ones that were pulled well I'm gonna pull uh 90 12. I have a question are there any others that somebody wants to pull yes I'd like to pull um 470 the covid mitigation plan sorry okay anybody else so if there's none others that people want to well can I get a motion 90 12. second nip okay so we have a motion in a second any discussion okay seeing none uh all those in favor signify by saying aye aye aye aye okay pass this five-year-old so the question I have on uh 9012 is about electronic communications and it's specifically notes on um Communications assets that are purchased or provided by the district like if the district was buying
your phone or your computer and it says that if it's not on a district one you need to send a statement to the district communication systems so does that mean you have to use the laptop that District gave you to send the communication about you had a conversation now it means you need to use the district email so uh anything District email anything you use through the district email account then we can access and if there is a public records act or a subpoena then then we have that okay that's that's really helps with the clarification thank you okay that was my only question does anybody else have any other questions about this no I move approval of um 9-0 was it one two but I know one too okay second there all right second
by Tom okay all those in favor aye aye aye aye all right thank you okay so now we move down to um zero four seven oh the covet mitigation plan and Matt thank you um yeah I think this thing is um just very over prescriptive I would personally um either eliminate this policy entirely or make it a very non-specific of what we will do if the law requires us to do something by all means we should go ahead and do it but I don't think we need to write a you know several pages of steps for ourselves um you know creating you know or or validating uh Etc just all these hoops for our staff and everybody to have to to jump through um we know that our community hates a lot of the things
that are in this I mean certainly not universally there's different different opinions but we've heard most loudly from our constituents who you know hate things like um associated with the vaccine and testing mandates people don't like the masks you know if there's a law there that we need to abide by let's abide by it but we don't need to be spelling out in all this detail what we're going to do and how we're going to do it Kelly it's my understanding that these generally come to us from [Music] um legal uh opinions from so just as clarification our board policies come to us from California school boards Association they have a program called gamut and what they do is they go back and update policies when there are changes to law when there's been court
cases that may impact things that are related to education so you know Mr tennis is accurate these the vast majority of this is a reciting of egg code these are laws that are in place regarding to covid that you know we will do whether or not they are in policy if it's Ed code we have to do it anyway but this does make it very clear you know what those expectations are I mean yeah my comment I I did go through and review this um quite closely to make sure that there wasn't something that left um our options other than following the law in question and I don't see any of that and I do believe that it is important for our own ability to um State why we are doing something that to not
do it the way we're would be against the law that this is only lawful orders and I think it's important to have that in place as our backup so that we don't have people questioning why we're doing something we have stayed so closely aligned with what we lawfully have to follow that I think it's important for us to continue to state that that's where we are we are only following the law all right anyone else would like to comment um I was a little confused because I didn't know if there was a motion on the floor but um uh I just if we're commenting um what I think is beneficial about having this document as a board policy is that it does break down the Ed code and the government code into bite-sized pieces and
just outlines you know where why these basically gives justification of why these are policies and then if anybody wants to get into the real legal jargon they can go see those policies rather than just say well we're following the law and that's what we're doing it helps to see It'll after after the strikeout stuff will be taken out it'll be about a two and a half page document if I'm reading through it correctly I am so I don't think it's too heavy and I think that it is helpful for our public who doesn't necessarily want to dive into the law or take us at our our word that we're following the law so so you know it it's fine um but that's just my interpretation here when you when you contrasted your um what we
appear to be about to do with the alternative philosophy of just telling people well we're going to follow the law and that's what we're going to do I got this warm fuzzy feeling in my my insides like that really is about what I would like to say um you know I mean the posture that I want to have with respect to the Newsome Administration and cdph at this point would be that of a you know angry offended turtle that would want to pull into its shell and um you know just just go about our business focusing on what we should be focused on which is giving the kids the best education experience that we can and not letting ourselves get into trouble but also not being all gushing out to the world about you know
all these Myriad steps we're going to take to you know bow down and kowtow to cdph and Newsome and honor every single thing that they say the way that this document does so maybe that gives a hint of where I'm leaning on this this issue my contextual framework and I've I'm quoting Kelly now that we'll not go above the law but we won't go beneath it in terms of what's obligated for us to do and I think it's fair for parents and students to see where that direction comes from because I think a lot of times it isn't clear to people and um again these are obligations that we Face legally so I'm in favor of letting them to be able to read it themselves see what the direction is and then in fact the
letter that we sent said basically in the letter that the yeah the one from the superintendent of the Butte County offset is basically let people know if they disagree about who to approach about changing it because these aren't within our power to change so I think it's it's fair that people see the direction know where it came from and then they'll know where they would like to Place pressure for change that would be my context so any other further comment anyone okay so we have the updated board policy zero four seven zero yes Eileen I'm of approval all right emotion um can I get a second sure I'll second that one too okay all right time seconds so all those in favor please indicate by saying aye aye ask for nose okay all right thank
you Okay so now we would go back to item 4.6 Madam president yes that's the discussion I I I would motion that we table that to our next board meeting and have it just before items board member requests for agendas I have a question about um when our our next Workshop is and I don't have the schedule in front of me February 2nd gotcha so we we would be able to have this discussion before the next board Workshop this action got you yes okay so just it might help for clarification it certainly would for me is um what we're considering between now and then is the impacts of a timed agenda is that is that what the discussion is um we had a we had a motion and we had a second and then it
got tabled and actually I don't know I don't know what the Rules of Order are at that point actually now we have a board memory request to move it to be agendized items to move it to a Time certain which is the next board agenda just before board member requests to agendize an item that would be uh January correct yes January okay do I have a second on that yep I'm going to second that too whenever you put in front of me okay so uh we have a motion uh uh to table to a Time search the table the the table of discussion of a time a agenda for workshops uh to January the 17th second yeah why are we tabling it [Music] why not discuss it right now and I think there was a
lot of good discussion originally and I can't remember half of it quite frankly I'd like to come back when when we have a clean shot at making a good decision on this issue and it wouldn't be implemented until the February Workshop anyway so we I'll just say that Caitlyn has snow on the ground and no power at her house so and and I probably a child that's sleeping at daycare right now the only thing I would say is then there would not be a change in the layout and it does not sound like you wanted that anyway other than the removal of the negotiations item for our regular agenda it was never it was never going to be the regular gender but you are correct yeah what was there was two there was two changes
we made what was the second change the negotiation to remove it and to provide clarity as to the start time oh right gotcha um would this be a point to say I think that we should use Bells instead of red and yellow paper for our speakers what that was another thing I was going to bring up for our for our meeting policies but yeah don't see right right I mean I don't know if that needs to be something that we like actually put into board policies we can take care of that Jim Jim get a bell okay it helps me you're like okay did we did we vote did we vote the table yet okay we're on we got a second well it goes to January 17th sorry we got a sec we have a
motion and a second but we haven't voted yet no we haven't voted yet okay so the the motion was to move the discussion of a timed agenda Workshop to January the 17th 19th all right yeah yes thank you all right any further comments okay all those in favor aye aye okay so are there any items from the floor um Madam president there's informational number two oh I'm sorry and since that was my request when I was um still board president I'm asking that that also be not dealt with tonight but table to ask for a written I mean I'm I have notes what I was going to say I'm sure we all do if we could just share them with Erica so that they can be published with the next agenda and not take up
time if that's agreeable I think we have to I think we have to actually approve that change so we need a motion in a second I think yes for that I put it in the form of a motion to table um I'll second to a written report at the connected with the the next uh agenda statement what's that report yeah do I have a second Tom Caitlyn did yeah okay huh okay my mistake any other comments all right all those in favor of moving the information obtained from the sessions at the California school board association annual Ed conference to a written statement to be presented January 19th correct that's correct all right signified by saying aye aye aye all right okay items from the floor we do see nobody raising their hands Okay so then
presented um we've agendized uh two things for the next meeting uh anything else any other yes um I I would like to request information about our bus fleet about our bus fleet um so just updates bus bus fleet a fleet of buses oh Fleet of buses oh my God uh if I Tom no Bob on to Ferris did a report that I saw float through just recently it was when we were acquiring another electric bus that gave the dates and mileage of all of our buses so I could be more specific or a little more detailed and just if there if there wasn't included in that some of the information that was shared tonight from our speaker from the floor uh Mr Keane about where the buses are being allocated and to whom and um
how how future spending is planned for our bus fleet for updates to our bus fleet to make sure that that we're making Equitable progress to our um improving our bus fleet I thought that was part of the report that I read if not I agree I thought we just got it though is it um Fair uh to ask that for January 19th or I don't think it has to necessarily be January excuse me we can work with the board president to schedule that at an appropriate time but if the information is available we'll certainly want to get it to you as soon as possible okay thank you okay okay any other requests to agenda is an item oh okay second okay all right any other discussion on that one all those information all right yeah
Matt did you say thank you I couldn't look I was coughing too much okay we are ready to adjourn hip hip hooray
