Okay. Good evening. Thank you all for being here and thank you for caring about those in our future, the at our school, our students, and the dedicated classified professionals who help keep this district running every single day. Tonight, I want to speak plainly about the challenges we are facing. Obstacles that are not abstract, not theoretical or distant. They are happening right now in our classrooms, in our departments, and in the lives of the employees who serve the district with loyalty and heart. Over the past week, we have witnessed a troubling pattern. the closure of entire departments and displacement of long-standing employees, all in the name
007of cost savings. Programs like Aspire NVI programs that serve some of our most vulnerable students are in the process of being outsourced. And let's be honest, contracting out may save money on the spreadsheet, but when it comes at a human cost, it disrupts continuity for students. And it sends a message to the people who have built these programs that they are disposable. But employees are not disposable. Our students needs are not negotiable and our commitment to public education should not be outsourced. As positions disappear, we see another trend. We're seeing another trend. AIDS and attendance being assigned restrictive, inappropriate duties under the guise of inclusion, support, or other duties. We've seen special education students moved in general education settings without proper staffing, training, or planning, then labeled as inclusion as if the terminology alone makes
008it equitable. We've seen employees spoken to in ways that diminish their professionalism and undermine their dignity. And we've seen support staff treated as partners, not as partners in education, but as stop gaps, plugged into whatever hole appears that day, regardless of the job description, training, or safety. It is not inclusion. This is not support. This is not how you build a healthy school community. And when staff are stretched thin, re reassigned without clarity, and spoken to without respect, it creates an environment where burnout is not a risk, it's an inevitability. We hear the phrase, we are filling positions, not people. We are restrictive services and no longer seen as a person who supports our students and teachers. Which leads us to the final issue, one that may seem small on paper, but speaks volumes about
009the culture we are creating. Lately, we've seen contracted hours shifted around, time taken from a Friday and moved to another day uh aids in attendance relocated to cover administrative manage mismanagement. And each time it's justified with the same phrase, other duties as assigned. But other duties as assigned was never meant to be a loophole for poor planning. It was never meant to be a tool to rewrite schedules on the fly. And it certainly wasn't ever meant to mass the systemic inefficiencies by placing the burden on classified employees. When minutes are moved, when schedules are altered, the duties are reassigned without transparency or collaboration. It sends a clear message. Your time is flexible, but our accountability is not. This is not sustainable. This is not respectful. And this is not how district committed to excellence treats
010its workforce. for IEP meetings. Aren't meeting notices sent to parents and other staff involved given advanced notice? Why are the substitute certificated positions not filled when a date has been agreed upon? [clears throat] Why are we pulled like it's a lastminute coverage problem? So tonight, I stand here not to criticize for the sake of criticism, but to call for something better, something worthy of our students and the people who serve them. We need transparency and decision-making. We need respect for the roles and expertise of classified professionals. We need stability for the programs that support our most vulnerable learners. And we need accountability not from the employees who are already giving everything they have, but from the system and leaders who shape their working conditions. Classified employees are the backbone of this district and they deserve
011to be treated with the dignity they deserve to be heard and and they deserve a workplace where their contributions are valued and not minimized. Together we can build that and ensure that every decision made in the district reflects the values we claim to uphold. Thank you. >> Thank you. Cha Vista educators, Miss Rosie Martinez. Good evening. Tonight I come with a heavy heart. Since the last board meeting that we had, we have sadly lost two of our teachers. Um, Esperansa taught at Lauderbach Elementary School. She had been a teacher in the district for many years. She was active in Chula Vista educators and at one point served as our treasurer. Another longtime teacher that we lost is Darcy Langfeld who taught at Liberty. We extend our deepest condolences to their families, loved ones, and to
012the Lauderbach and Liberty communities. When I'm done speaking, I would like to request a moment of silence to honor and remember them. They are an example of the amazing talent and dedication that we find around this district. Teachers, social workers, nurses, psychologists, speech pathologists, I could go on. All who choose serving students as a career are caring, empathetic, and passionate. Today I got the opportunity to join the teacher of the year committee and read many many letters of recommendation for candidates that were selected by their peers from 35 of our schools. It was amazing to read about all the impactful work that is happening in our classrooms all across the district. I can't wait to visit their sites and see them in action next week. The highlight of my position is to be able to
013go into the different campuses and see the learning that is taking place. Although it is wonderful to recognize the great work, praise is not enough for our employees. They also need opportunity um appropriate compensation and health coverage for themselves and for their families. The cost of living is becoming more and more challenging for many. District employees should be able to afford the essentials for their families such as food, shelter, and access to health care. CVE recognizes the financial situation for the district, but we also ask that you recognize the financial situation for our members. The cost increase to health care means many of our members took a pay cut this month. Those who took those who cover one family member are paying around $800 a month and those covering their families are paying around $1,500
014a month. We continue to ask that you consider the quality of life of your employees. We understand the importance and difficulty of the duties um that you have as trustees and the tough decisions that you must make to ensure that our district remains remains the best place to be. As we enter into an election year, CBE's political action committee met today to discuss our endorsement process that we've begun. Any candidate that is interested in our endorsement should reach out to us before February 6th. We are looking for candidates that understand and support public education and approp and appreciate the work that we do for students here in Chula Vista. As strong supporters of community schools, we want candidates that unite our community in our work to support the students and the community of Chula Vista
015at large. We see parents as partners. We want to continue to work together in the in a collaborative way. We are proud of the strong relationships that we have built with this district's leadership. We want to expand that collaboration to include our parents and community members. At a time when education is under attack, we must stand together and keep a clear focus on our students. We cannot feed into the negative and divisive narratives that distract us from this important work. Thank you. >> Thank you. Administrators Association. Oh, sorry. I'm sorry. The moment of silent. I'm sorry. Um, please uh bow your head in a moment of silence for the teachers that we lost since our last meeting. Thank you. Assoc uh excuse me, administrators association, Chiliva Vista, Miss um Terresa Corona. >> Thank you. Good
016evening, President Trustees and Dr. Reyes. On December 17th, I addressed this board on behalf of AACV regarding the closed campus policy and the support AACV had for your original board policy. I later spoke to this board about our disappointment with your decision to revise the policy. I want to return to that time, not to reopen the debate of course, but to speak to what followed and what we as a district should learn from that experience. After the policy was initially passed in November, principles did exactly what this board expects us to do. We carried it out. We implemented the board's direction in good faith. The work required significant time and labor. And you know what what that that was? Communicating with families, redesigning supervision plans, reallocating staff, responding to questions, managing community concerns at the
017site level. And when the policy was revised just one month later, the reversal did not just simply change direction. It multiplied the workload. And that's what I want to really lay out tonight that when the policy was reversed, we still had to go back and recommunicate, readjust, and explain why changes were made after implementation had already begun at many of the sites. So many of us are still engaged in the work right now of how things are going to be at the school site to carry out the the new board policy. And all of this occurs while we are still fully accountable for safety, for supervision, and for daily operations. I I shared with you that it was discouraging and disappointing for our members what occurred and not only because of the outcome but because
018of the invisible labor, the stuff that happens behind the scenes and how a policy change like what you what happened in December required us to really pivot at midstream. It's also important to note that none of that work advances student achievement or instructional improvement. It pulled time and focus away from the core work principles are expected to do and that we are should be instructional leaders in our schools. These are important. There were important lessons in what occurred for our district. First, implementation matters. When the board passes policy, especially unanimous unanimously, or when our district presents a roll out of a new plan or a new initiative, school leaders are the ones that carry these initiatives out. And it takes time and it should be implemented with the clarity for us to be able to
019carry out whatever initiative or policy it is. So the other piece I think to take away from this is that principal voice matters. Principles are closest to the daily realities of supervision, staffing, safety, uh student behavior. Our perspective is operational and practical. When policies are revised without meaningful administrator input, then the district risk decisions that appear reasonable on paper but create strain and inefficiency in our practice. Third, I want to reinforce the importance of chain of command, not only for leadership clarity, but for responsible use of district resources. When community concerns bypass school sites and move directly to the district or to the board, issues that could have been resolved locally often escalate unnecessarily. And finally, I I want to address that as we move deeper into rigorous learning for all and begin the work
020for setting actions and goals for 2627, those are where those lessons that I mentioned should be implemented. So we could remain committed to collaboration and to the success of this district. But collaboration requires that principal voices value implementation is respected and governance decisions are given the stability they need to succeed. Thank you very much. >> Thank you. >> Oral communications. The oral communication section provides the public with an opportunity to address the board on non-aggenda items. Persons wishing to be heard may attend in person and should complete a request to be heard card and submit it to the recording secretary before the start of the meeting. Speakers are requested to limit their remarks to three minutes and speak in a respectful and professional manner. The board shall limit the total time for public input on
021each topic to 20 minutes. With board consent, the president may increase or decrease the time allowed for public comments depending on the number of persons wishing to be heard. The board of trustees cannot legally take action or respond to matters not posted on the public agenda due to government code, but will refer the matters to the superintendent for review and report. Cara Good, I'll read quickly. Might go over three minutes. Superintendent Reyes and school board members. My name is Cara Good and I'm a parent concerned about cuts of counselors, PE teachers, and behavioral assistance projected for next year. This district was at the forefront of mental health after the pandemic with all the services they provided. The need has not changed. Not only are students struggling with mental health, but so are staff members. I
022understand that there's a district safety committee. My question is, have you considered the impact of mental health on school safety and the classroom learning environment? These cuts will negatively impact the mental health of our students and staff. It has been said that the board does not want to make cuts that will affect the classroom. These cuts will impact the classroom and school culture. Most of our children's waking hours during the week are spent at school. Having a counselor on campus, a behavioral assistant available to be in the classroom, and an outlet to be physically active outside of recess via PE class are essential. School is accessible to all, and therefore, everyone has access to the forementioned services. Counseling services and behavioral services in the private sector are expensive, and insurance doesn't does not necessarily cover
023these services. Having these services available at school eliminates barriers and increases accessibility to all. Similar to the threat assessments that the district conducted prior to purchasing safety items and hiring safety personnel, has a district conducted mental health assessments at our schools. If we are not placing an importance on mental health and mental health services, there will always be a major missing component in keeping our schools safe. The bipartisan safer safer communities act passed in 2022 approved funding for mental health services at our schools. Did CVESD receive any of that before funding was frozen in April of last year? Can the district apply for grants focused on mental health? Has the district looked at possible reimbursement through the state Medicaid program? The district is concerned with the chronic absenteeism. If you cut mental health services, this
024problem will get worse. The CDC conducted a survey and determined that if a student felt connected to their school community and felt cared about, they were more likely to succeed. The National Alliance on Mental Health said one in six youth aged 6 to 17 experience a mental health disorder each year and half of all mental health conditions begin by age 14. They said, "Children spend much of their productive time in educational settings. Schools offer a unique opportunity for early identification, prevention, and intervent interventions that serve students where they already are. According to the Learning Policy Institute, research reveals that providing school-based mental health services can have just a little bit more time. in school and elementary schools positively affects students mental health and the presence of qualified and supported school counselors reduces disciplinary incidents improves
025teacher perceptions of school climate and student behavior and increases boys academic achievement. In conclusion, as mental health concerns increase and funding decreases for mental health services, I believe it would benefit the district to create mental health communities of counselors, nurses, psychologists, behavioral assistants, and teachers to evaluate the needs and coordinate creative solutions at their respective schools. Similar to school safety committees, I would encourage the district to not make these cuts to our school mental health services as these cuts will negatively impact our students, their families, and school staff. Thank you for your time. >> Thank you, Deia Robinson. [applause] Good evening. As all of you know, I attend all of the board members and have never spoken. Today is different. A few months ago, at a board meeting, we were told that the district was
026considering uh deciding whether or not to continue with the achieve program. Friday, our union president reiterated this fact and sent out a survey to all teachers. After speaking with my colleagues, I would like to you to hear from us directly. While we are not married to achieve, we would like to ask that if it is removed that something is comparable, that a program that is comparable, it takes its place. Of course, achieve is only one facet of our reading program, but it is a valuable tool in an educator's toolbox. One of Achieve's greatest strengths is its access to differentiated reading levels, ranging from beginning readers all the way through high school. In my class alone, not only do I teach in two languages, but I have students reading from first to 11th grade levels and
027everywhere in between. Achieve allows us to give every student access to the same content but at a level that they can actually read and understand. For example, if I am teaching a lesson on Martin Luther King, I can assign the same article to all students and students and each student will receive it at their level. There is no way that one teacher could do this for 30 students, let alone do it several times a week for two languages. In addition, each article includes spiral review of reading standards. Students aren't just reading the content, but they are continuously practicing comprehension skills such as main idea, inferencing, vocabulary, and text structure. And with topics that the children enjoy such as such as space, history, technology, animal kingdom, the topics are endless. With Achieve, children practice reading and
028we receive feedback immediately. Parents, children, and teachers know instantly if the child understood the material or not. Teachers can then use this information to go back and teach those areas of need. Lastly, Achieve is a strong predictor of CASP performance. This means the data that we get from Achieve can help us identify students early who may need support before testing. This in turn allows us to intervene sooner and more effectively. And let me reassure you, while the trimesterly level set may focus on vocabulary, the article activities and lessons focus on reading skills and standards as mentioned above. To conclude, I would like to reiterate that we are not married to achieve. However, we do see the vast benefits of the program. If it is no longer available to us, we are asking you, begging you
029to please replace it with a comparable program because I as one teacher cannot differentiate at the same level. No provide the instantaneous feedback. Thank you very much. Thank you [applause] Claudia Pischica. Good evening board members and superintendent. I'm here to speak about the layoffs of the behavior support assistants or BSAs. And let's be very clear, your decision directly affects all classrooms. Behavior support assistants were hired into roles that were never fully defined and never fully funded. We were told to step into crisis first and figure out the rest later. We were told to lead with empathy, to be traumainformed, and to support students even before their training could arrive. And we did. This year alone, my hair was pulled out. My glasses were broken. I was bitten. And I kept showing up. Not because it
030was easy, but because the students needed someone calm when everything around them felt so overwhelming. And we do this work so these little humans can regulate their emotions and access their learning. We do it so teachers can teach the other 23 students in the classroom while one child is in crisis and that child receives care with dignity, respect, and safety. And that's not extra support anymore. We're the support that is essential. I've crafted behavior charts so every classroom shares a common language that their feelings matter. I've created visuals for be safe, be respectful, be responsible. I closely collaborate with both my administrators daily. I count the treasure slips. I manage the reinforcers. I furnished a cozy cove at Rogers for all our students. And I help keep our PBIS system alive. Now, fortunately, at my
031school, we're going to continue to fully fund a BSA next year. and our students will keep these positive systems in place. But 30 other schools in this district will not. 30 behavior support assistants will be laid off this June. Many will leave this district entirely because they cannot afford to stay where their work is treated as temporary and expendable and without warning and without transparency that this was only ever a one-year position. To say this cut does not affect classrooms is simply not true. And when you remove behavior support assistance, you remove safety, regulation, and access to learning. And that's a great loss that all of our students in Chula Vista will feel. Thank you. Thank you, [applause] Deia Dominguez Cvantes. Are we gonna start? >> Okay. Partnerships are built on trust. Trust grows from
032transparency and transparency stems from honesty and ensures accountability. I understand why our community doubts our sincere our our sincerity. Too many concerns fall on deaf ears. Examples of being ignored or misled. Since December 2022, I informed my one employee that the board needed to be sworn in by an authorized official. The criminal penalty for not doing so is a misdemeanor. That was the responsibility of my one employee to inform all our board members. I was sworn in correctly. I have repeatedly asked to identify students who do not meet academic standards to provide them with the appropriate supports ignored. I've been chasing the Title One money for years only to find out not every school site knew exactly how much Title One money they were entitled to. the difference rolled over to the district who reallocated
033that unused money. Figmat, I requested the assessment and that I also requested that the investigators speak to me before the start. The latter was ignored. I requested my one employee to be put on admin leave to preserve the integrity of his investigation. I was ignored amongst multiple things. I asked to speak to legal about this and other items ignored. The superintendent's contract dated at May 24, 2024 that I brought up September 10th of 2025 is signed by whom it says as president Ugarte and Vice President Tamayo. I have no doubt that the paper was just put under these two board members. Trustee Tamayo was not the VP then. Caesar Fernandez was that is a total misrepresentation. The lack of DI curriculum. I inquired about this since July when the school started. School season started through
034November. I was led to believe that staff was acting outside of his direction. Staff, I apologize to you from the deepest parts of my heart because you were told one thing, but I was told another. We were pawns. Multiple press releases were either complete news to me, inconsistent, or a variation of what had previously been told to me. We should never misrepresent anything. Lying is wrong. My one employee claimed he never sees the bids until the final sign off. But in November 2024, he told me directly that a lower bid, he knew a lower bid had been submitted by W2W. That was the reason he said it was pulled from the agenda. That is not what was communicated to the media. Last month, Miss Leticia Seura, who I don't know, announced to a group of
035people that my one employee recruited her to run against me. surprised. No, my one employee is retaliating against me for asking too many questions and undermining my soliciting by soliciting others to do his bidding. I ask everyone to forgive me for believing that you were doing something that I was told. This is being done to shut me up, but I will not be bullied. We have options, but the worst option is to do nothing. My integrity is not negotiable. I have a moral obligation to do my job. I am not here to get your approval. I wish we were all on the same page. I'm here as a voice for parents, staff, and most importantly, the children that I know you are all dedicated to support. I encourage parents to continue to stay involved. That
036is my most heartfelt wish to work in partnership with our school staff who work so hard and so often go unappreciated. Thank you. Thank you, [applause] Bertha Lopez. I Bertha Lopez. >> Okay. I was listening to the wonderful speech. I'm sorry. >> Oops. I forgot my glasses. >> Good evening. I speak tonight out of concern for how this board is exercising its authority. A board of trustee exists to govern in the best interest of students in the community and staff and not to manage personal disagreements. And this has happened in many other meetings. At the last board meeting, Mr. Damayo, you kept cutting off your colleague before she even finished her sentences. Miss Ugarte, your behavior while the speakers were expressing their concerns was a bit to be desired. Miss Tolson, please listen to the
037parents. The only voice that I hear from you is second. Please watch the recording as I did. Disagreement is not misconduct. Asking hard questions is not disloyalty. In fact, it is often the very reason why trustees are elected. It is troubling to see that tonight's policies are being reviewed or reshaped in a way that appears targeted, especially after this board has chosen to move forward without external help such as CSBA. When governance tools are used to retaliate against any fellow trustees, it undermines trust, credibility, and the integrity of this board. Let me remind you to all of you that are sitting out there that this institution is a public institution and it does not belong to individuals. It belongs to the community. Silencing disscent sends a dangerous message account that accountability does not matter that
038comfort is valued over transparency. I urge this board to refocus on its responsibility to students, to fairness, and to public trust. Govern with integrity, not resentment. The community is watching you. And I just want to put out a shout out to all of you that are here. Please, if you don't not do not believe what I'm saying, read the articles that are in the Voice of San Diego. And please, I I see your faces up there. Get some smiles. We're all here smiling. We're all We're all supposed to be working together. That's just my last shout out. Thank you so much. Thank you, [applause] >> Laura Green. Good evening. My name is Laura Green. I'm here to speak to you tonight as a public health nurse that works daily in this community to mitigate the
039mental health crisis. and as a parent of five children ages 10 to 17. My youngest is a fifth grader who attends Hailrest Elementary School special day class mild mod program right up the street. I'm serving my second term as a school site council member and my second year as a site council member at Hailrest. I'm sharing all of this with you, hoping to communicate that I have an understanding of best practices in mental health care, child development, social determinance of health, equity, as well as our school's budget, funding sources, and programs. I am also deeply aware that we're facing some brutal choices in our district as we deal with budget cuts from the federal government. I live this every day. The choices that we make are going to affect educational and health outcomes for decades,
040if not generations. After the outcry from families in our district at the loss of district provided funding for mental health last year, language was changed, but the product is the same. Our schools are now forced to sightfund our social workers and counselors. Hailrest has always prioritize the mental health of our children. We've sightf funded half of the salary of our social worker, Mrs. Sarah Fogelman for over four years. In this time, Miss Sarah has been instrumental in creating the culture of our school through individual counseling, facilitating support groups, creating clubs, and supporting our educators in and out of the classroom. Sarah is a fundamental part of the team and culture of our school and Hailrest is an extraordinary school because it has an extraordinary team. I was informed last week that Miss Sarah would not
041be returning to Hailrest next year. The counseling position that our school is site funding will be filled without our site's input. according to district seniority. That's why I'm here. I'm asking you to make a decision based on what is best for our children, what is best for our school, and what follows evidence-based practice scientific recommendations. The effectiveness of a school social worker is rooted in their ability to trust, to build trust, make connections with families, to students, and throughout the community. There is absolutely no language in the social worker counselor contract that justifies this decision. It appears to have been made for convenience of adult central office staff who are responsible for filling positions. decisions regarding the needs of our children should always prioritize their mental health and education. I call on the board to
042reverse this HR staffing decision and to again place the mental health and educational needs of our extraordinary students first. On a personal level, my 13-year-old is well and thriving because of Mrs. Sarah. >> Thanks for your time. Thank you, [applause] >> Paresa Hill. Paresa. Good evening. My name is Teresa Hill. I'm a parent at Allen Elementary and a community advocate, a member of school site council, and the founder of Bonita Mamas. Thank you to the board for listening to parents concerns last month and amending the closed campus policy to allow parents to wrap her in for morning drop off. The night before students returned from break at Allen, families received a letter from our principal outlining new drop off procedures that have created additional barriers, especially for TK and kindergarten families. Parents are now prohibited
043from entering the TK play area during during morning drop off without a Y. As a result, I've had to leave my 5-year-old child with a staff member that we were never introduced to and whose name we do not know. Additionally, parents have been instructed to exit campus at 8:45. Yet, teachers are not consistently present outside to supervise or pick up their morning lines. The letter also stated to speak to teachers, please email to schedule an appointment. While I was fortunate that our teacher responded quickly yesterday to my dojo message, that's not always the case for other teachers, and it's not always realistic for families. Not every concern requires a formal meeting. Sometimes parents simply need a brief, timely check-in to support their child's success. These restrictions continue to erode the parent teacher relationship that research
044shows are essential to student success. Allan went from having 70 to 90 parents drop off their children in the morning to now less than half. And to recap, Allen at at Allen, we already have limited opportunities to participate. There are no volunteers allowed in kindergarten classrooms. Parents cannot enter the TK yard. We are no longer allowed to shop our own walking field trips. And the only opportunity we were offered last last quarter was because I had requested it. Otherwise, the families would have zero opportunities to engage with their kindergarteners. I have watched our close-knit community of supportive, engaged parents be pushed out and shut down, and this is unacceptable. This does not align with the Chula Vista Elementary School District stated commitment to welcoming parent involvement. Allan cannot be successful without the continued support of
045parents. Thank you. Thank you. [applause] Oral presentations and written reports. The district safety health update. Dr. Rosendale. >> Good evening. At this time, we have no updates. >> Thank you. Approval of the consent calendar. The following items listed under the consent calendar are considered by the board in one action. There will be no discussion on these items prior to the time the board votes on the motion unless members of the board, staff or public request specific items to be discussed and or removed from the consent calendar. The staff has pulled item 10 C subsection D, the job description, and I believe Mr. Pong. That's your item. Okay. So, 10 C. Starting with Trustee Ramirez Dominguez. Do you have any items to be pulled from the consent? >> Yes. Item 10. 10 CJ J 10 D
04610 E 10 F 10 G 10 H. And that's it. >> Thank you. Trustee Dominguez CVantes >> 10 CHJ, excuse me, page seven of 11. >> Mhm. and 10H, please. >> Thank you. That's all. Trusty Tolson, >> I have nothing. >> Trusty, >> nothing. >> Thank you. All right. Do I have a motion to consider the cons to accept the consent calendar without items 10 CJ, 10 D, 10 E, 10 F, 10 G, and 10 H >> and 10 C D. >> You said CJ, right? >> 10 C >> CD. Yes. And 10 CD. Yes. Gotcha. They both they were both I I saw what she meant then trusty deo do I have a motion >> second >> motioned by um trustee Ramirez Dominguez seconded by trustee Tamayo recording secretary please call the vote >>
047Ramirez Dominguez >> I Dominguez I >> Tolston I >> motion carries unanimously starting with item 10 CD Mr. Pong. >> Thank you, President Ugarte. Um, the staff would like to make a typo correction on the job description on page 10 under the qualifications instead of on the fourth bullet point on say currently states category A, but it should be category B for the certificate requirement. Could you >> It's at the very bottom of the page. It's the last bullet point. >> So, it should say what? >> Category B. >> B is a boy. >> Yes. >> Thank you. >> Okay. Thank you. Item 10 CJ. Trustee Ramdes Dominguez. >> On page seven of 11, I have two. The first one is Nicole Miller and Associates will provide the district a fullervice independent invest in investigative
048services as needed. My questions are and I'm going to start with uh can I please have a scenario when we would contract this company? >> Dr. Reyes. So if there's an investigation where we need to uh when we the district feels or uh the board president feels that it is best to have an independent investigator conduct investigation then we would hire this this uh firm. >> Okay. um >> in that process. So it would be like on our staff [clears throat] >> or investigating people like I I just want to know like are we investigating in within the district or is it like outside sources we were investigating >> within the district. >> Okay. So we would investigate within >> situations within the district. >> Okay. Um and it said that we would be paying
049them $250 per hour. Um usually how much do we end up paying? Have we done this before? >> Yes. So from districts uh from time to time hire outside agencies >> and it varies on the scope depending on the scope. >> Yeah. Okay. Those were my questions. >> Trusty Domante. >> Oh, sorry. I have another one. Sorry. >> That was my question on that one. The next one, uh, Roman truck body. Roman trucks body and paint will be painting, um, on I like the name of the paint, national school bus yellow. Um, I was just wondering, are we painting all of our trucks? There you go. >> It it's [laughter] it's basically as needed to make sure that we comply with the CHP. >> Okay. Uh so they they require our buses to be painted
050uh yellow color but a special tone. So as as sometimes they fade because of the sun. So then those would be painted. >> So it's it's not like every year every other year it's >> As needed. Okay. And that amount of money we're paying as if it's as needed. >> It's up to that amount. Correct. >> It's up to them. >> As needed. >> Okay. Okay. Yes. Thank you, >> Trusty Dominguez. >> Yes. Under um excuse me, on page four of under resignations, personnel continuing education. I have an issue with one of the individuals that's listed here as res resigning because I do not feel that I had all the information and as information has trickled out. I may have changed my vote had I had that information prior. >> So are you not wanting
051to vote on this item? >> Correct. Yes. Correct. Okay. Any other? >> Is that all for 10 CJ? >> Okay. I will entertain a motion to um approve item 10 C. >> Move to approve >> with the Yeah. correction that Mr. Pong made. >> With the correction. >> Do you have a second? >> Second. >> Moved by Trusty Tomo, seconded by Trusty Tolston. Recording secretary, please call the vote. Ramirez Dominguez. I Dominguez. Nay >> Tolston >> I >> Damayo >> I motion carries 41 item 10D trustee Ramirez Dominguez >> okay >> yes uh the employee the CSU employee implementation uh is this the one yeah >> um so I believe that there's a great idea for us to collaborate with higher education uh for us to also able to you you know, support our employees
052and to gain retention. Uh, I just want to know how much or how does who's paying for what? Dr. Reyes. >> Uh, Grant. >> Yes, thank you for the question. So, this is in collaboration with University of San Diego for a teacher residency grant with the CTC. Um, so we were very cautious that um that this would be budget neutral for the district. We are applying for a grant. So it would be funded by the grant if awarded to us. >> So basically we would move on if we get the grant. >> That's correct. >> Okay. So we're not >> subjecting our money to something new. >> That's correct. We're we're in the application process. >> Okay. When do we know? >> We're hoping to know by the end of June. >> The end of
053June. Are we going to get an update? >> Yes. I'll provide updates as I receive them. >> Thank you so much. >> Thank you. Move to approve. >> Second. >> Moved by trustee Ramirez Dominguez. Seconded by trustee Tomo. Recording secretary. Please call the vote. >> Ramirez Dominguez. Hi. >> Dominguez. >> Hi. >> Tolston. >> Hi. >> I. Motion carries unanimously. Item 10E. Trustee Ramirez Dominguez. >> Yes. Uh the approval of the school accountability report cards. Uh I must be missing something. Be um can we get more explanation of what these report cards? I thought they were we would have them like to see them or >> Dr. Reyes >> May >> the school accountability report card is a document that's updated by our principles on a yearly basis. It's also autopop populated with data from
054CDE on a yearly basis as well and then it is um posted on the district websites. >> Is it up already? Can I find it? These are not up already because they come to the board for approval before they're posted. Oh, >> could we see them before? >> Have you did you request them? >> Uh, I thought there will be I thought there was a misprint print out. Um, and I I was going to ask and then I looked if we had them online, but also I see the public doesn't have them. So, is it only by request? So what would typically happen is in our internal process we have uh Miss Castro in our communications department. What they do is they send communication to all of our principles about all the different areas that
055they need to update. Then she checks them to make sure that they are all updated and then what happens is our senior directors support their cohorts of principles. They read, they review, and they give feedback on all of the school accountability report cards to the principles to make any changes that they can make. some of it is autopop populated with data. >> Um, and then they come through me and our team spot checks them and looks for any errors or inconsistencies that we would like to follow up on. >> Um, and then they go to the board for approval. So, we have an internal process of reviewing them like our other documents. >> Okay. I was just making sure that if the public wanted to see them also, they could, but of what I'm hearing,
056it's a no. Trusty, we're checking because we thought we might have seen them in the one drive, but we're not sure if they were uploaded. >> Um, I did not receive anything. I I >> We're just checking to make sure. >> Thank you. Yeah, I just wanted to make sure we all had the information. >> This is an action item and if it's on the one drive, I don't have access. this. >> So, I mean pending we we have co we can get you copies of the report cards if you want to uh or the PDFs of them. >> Whichever one's faster so I can review. >> Probably the PDFs >> most likely. >> So, um I'll move for approval of this item with uh the condition that we provide PDF access to the trustees.
057Yeah, they're actually uploaded. Uh they have been uploaded. >> I thought that I saw it on our update, but just wanted to make sure that if we can send the link to in the directory where the they're at uh so they can review them, then um >> that's that's my motion. >> Is there a second? >> Second. >> Moved by Trusty Tamayo, seconded by Trustee Dominguez Arvantes. Recording secretary, please call the vote. Ramirez Dominguez. >> Hi, Dominguez. >> CVantes. Hi, >> Tolston. Hi, >> Tamayo. Hi, >> I. Motion carries unanimously. Item 10F, Trustee Ramirez Dominguez. >> Uh, yes. 10 F. Yes. Review the quarterly reports was So, what I see right now is that there's no issues or Sorry. >> Just trusty. Um, I mean, excuse me, >> please. Um, so that is Miss Mor
058is that Miss uh that's Miss Morales again? >> No, but what's the question? >> If there's no reports, right? Is that >> there? Is that my question? >> There's no words. >> Correct. So, right now there's no reports. >> Okay. My sec my follow-up question to that is I remember a few months ago an incident where multiple parents came up and said they will file a report. Does it mean that the report wasn't filed or didn't file correctly? Is there any follow-up to that? >> Can you spec specify the school? >> The instance with a Royal Vista where they had no toilet paper. >> So, uh, a report was filed, but since they are a charter school, we did check with the county office of ed. And because it's a it's a charter school, it
059wouldn't come here. Besides, it's out of the window of even if it would have been in one of our schools, it would not fall into this report because it's out of the window for filing for this one. But, uh, however, it will not be filed with us because it it will file with their council, their charter council. Oh, >> okay. So, again, because it's a charter school, they have their own council for safety. Is it a will is it also like the Williams >> report? So the council is kind of like the their own board. >> Okay. >> So So uh for example, Discovery has a board. Uh Aroyo Vista has a council. So we did check with Sanio County Office of Education and they we were informed that that report that Williams report should
060go to the council for Vista. >> Okay. >> May I based on what was just shared? So if we're the ones that select and appoint the principles, right? >> Correct. For for that for that school. Yes. >> Okay. So for that school, isn't it our responsibility to work with our leadership there to ensure that this doesn't occur? So I'm wondering where the where that fine line is where we I don't I don't want to pe it appears like we're washing our hands of that. >> Okay. So we're talking about two different things. She's asking about the Williams report the responsibility of the principal. >> There are two different things. Uh she asked about the Williams the Williams report and the Williams the Williams complained uh goes to the council in regards to responsibility with the
061principal. If uh you recall recall when that happened um I did uh speak to the principal and I sent a follow-up email uh with information. I shared information of the things that the principal had put in place because that was our concern. It happened. We can't change the past, but moving forward, we want to make sure we want to ensure that it doesn't happen again. So, uh she um shared all the things that she put in place uh to make sure that it didn't happen again. for example, um, uh, checking the bath, having the the custodial custodian check the bathrooms, uh, on a on a rout routine basis, etc. So, so that has been implemented directly with the principal, but but it's separate from the Williams. >> I don't know if we'll still have time
062at the end. I know last month we didn't have an opportunity to get to uh, board uh, reports or board comments. So in case that gets cut off, could I ask that we request that we get a better understanding, maybe a presentation of our responsibility to charter schools, dependent and non-dependent? >> Yes, >> that's appropriate. >> Is that a consensus that it gets on the agenda for next month? >> Yes. >> So it's a second. >> Yes. Second. I thought he said second, but >> President regard that that means it gets on the agenda. Thank you. This is an action item. >> Second. >> Moved by Trusty Tamayo, seconded by Trustee Ramirez Dominguez. Recording secretary. Please call the vote. >> Ramirez Dominguez. >> Hi. >> Dominguez. >> Hi. >> Tolston. >> Hi. >> Tamayo. >>
063I. Motion carries unanimously. Item 10G. Trustee Ramirez Dominguez. Can I have more information as to why the migration is happening, >> Mr. Pong? >> Yes. Overall, it's to modernize our our telephone system and we're transitioning over to Teams, which provides us more flexibility and integration with our whole Microsoft suite. So, >> is it for like the phones at schools? >> Yes. >> Okay. Um, would that also be attributing a cost for like our Wi-Fi or, you know, our internet costs? >> That's a separate cost. >> Okay. >> Mhm. >> Um, and it says till the end of the project, it doesn't matter. It would only be 10,145 with 50 cents. No matter how long they take to do it. >> Yes. >> Okay. Move to approve. >> Second. >> Moved by Trustee Ramdes Dominguez. Seconded
064by trustee Tamayo. Recording secretary, please call the vote. >> Ramirez Dominguez. >> Hi. >> Dominguez. >> Hi. >> Tolston. >> Hi. >> Tamayo. >> I. Motion carries unanimously. 10H. Trustee Ramirez Dominguez. >> Thank you. Uh, as I read the approval approve renewal of coalition of adequate school housing cash. Uh, can I have more information on this membership please? >> Yeah. So cash is the the statewide organization. They're representing school facility professionals. So in this case uh Mr. Pong the facilities uh team and uh they have everything from uh conferences to uh uh information workshops. Uh so each agency is for example AXA is for administrators, cash uh is for um facility uh managers or supervisors. >> Yes. Thank you. Um it said in the description that we actually get um discounts for their events, right?
065>> Correct. >> Okay. Um do you happen to know how much discount we get? >> I don't Mr. B. >> It varies by program, but usually it's um you know$100 to $200 per person. Yeah. >> Because I see a traveling request for $11,000 for cash academy. So, I was wondering if that's counting the discount. >> It is. >> So, it's more expensive than $11,000. >> Correct. >> Okay. I'll be asking more, but when we get there. Thank you. >> Move to approve 10H. >> Second. >> Uh, moved by Trusty Tamo, seconded by Trustee Tolston. Recording secretary, please. Oh, I'm sorry, Trusty Dominguez. I I did see you pull 10 H. I'm sorry. We can still discuss with this person in a second. So, we're good. >> Okay. >> Approve renewal of coalition for adequate school
066housing membership for the period of February 1st, 26 through January 31st, 2027. I just wanted a little bit a little more of explanation of what it is we're approving. Miss Bron, >> this grants the district an organizational membership to the association. So, we get all the update bulletins that we would otherwise not receive if we were u if we weren't members of the association. Um, as Miss um Dominguez mentioned, we get conference discounts. Um there's mentorship programs, things like that. So, there's a lot of benefits to a professional association like this. may continue with a question on that. >> So, I know that u it's been a while, probably more than a year since the subcommittee for the staff housing that uh trusted Tamayo and I were part of and I don't know if that's
067connected to this. Did something fall off? >> So, it says housing, but we're not talking about staff housing. Okay. >> We're talking about school housing, meaning classrooms. Oh, >> okay. Thank you. That's any. Okay. So, we do have a first and a second. Recording secretary, please call the vote. >> Dominguez. Hi. Dominguez. Hi. >> Tolston. >> I. [clears throat] Motion carries unanimously. At this time, I would um like to welcome Dr. Angela Rosenale to announce our newly hired and promoted employees with respect to especially our newest hire. >> Yes. Thank you so much for this opportunity. We are very excited to announce the promotions for this board meeting. We have Roberto Aguilar moving from custodian to gardener groundskeeper. Samuel Contras from van driver to bus driver. Pamela Neilo from riskmanagement specialist to benefits and risk
068management lead. Erica Thomas from instructional assistant special education to student attendant. Christian Vargas from van driver to bus driver. and we had the amazing opportunity to have our board tonight interview um for the senior director of phys facilities planning maintenance operations. That's a big title there. Um we are excited to announce our newest member of our CVSD family, Mark Aronda. He comes to us from Orange Unified School District with a wide breath of experience as a construction manager, facilities project manager, director of maintenance, operations, transportation and facilities just to name a few. So, welcome to Mark and we invite you to the podium to say a few words. [applause] Uh, dear board members, Dr. cabinet members and the committee of the Chula Vista Elementary School District. Uh I would like to thank you this opportunity
069uh to be your next senior director of facilities maintenance and operations. I am blessed for this opportunity and look forward to continuing to provide a safe learning working environment for the students and staff. Thank you very much. >> Thank you. Welcome and congratulations to everyone. [applause] Okay. Public hearings. The public hearing section provides the public with an opportunity to address the board on specific items. Persons wishing to address the board on any public hearing item must complete a request to be heard card and submit it to the recording secretary before the start of the meeting. Speakers are requested to limit their remarks to three minutes and speak in a respectful and professional manner. The board shall limit the total time for input on each public hearing item to 20 minutes. With board consent, the president
070may increase or decrease time allowed for public comments on each public hearing item depending on the topic and number of persons wishing to be heard. The first item is conducting a public hearing to perform a specified service for the period of January 26, 2026 through May 1, 2026 and adopt a resolution regarding short-term classified employees. Dr. Rosenale, >> I'm actually going to pass this one to Mark P. >> Thank you. So [clears throat] this year we have been refreshing our um student devices and teacher devices and we have received all the materials. Our Chromebook devices have been deployed. Um our next phase is our uh teacher laptops and so we have a need for some additional assistance during the school day to be able to deploy those to go out to the school sites and
071um swap them out with the with the current computers. So this would allow us to have some temporary help with that. >> Board questions or comments? >> I do. >> Is there a schedule that has already been shared with the leadership principles so they know when this is going to happen and staff knows when this is going to happen only because some staff have inquired as to well we've been waiting we've been waiting but we know things are. So, our IT team has been working on um some some job aids to help with the migration and then um we plan on bringing that to our uh monthly operational meeting for the um site leadership. >> When when do you expect that to occur? >> We have an operational meeting at the end of this month,
072next week. >> All the principles attend that meeting? >> Yes. >> Okay. Thank you. Any other board questions or comments? I'm now opening the public hearing. Any speakers? Seeing no speakers, I'm now closing the public hearing. This is an action item. >> Move to approve 11B. >> Second. >> Moved by Trustee Tolston, seconded by Trustee Dominguez Cvantes. Recording secretary, please call the vote. >> Dominguez, >> I Dominguez, >> hi. >> Tolston, >> Iard >> I. Motion carries 5-0. >> Conduct a public hearing to receive input on the initial collective negotiations proposal from Chula Vista classified employee organization to the Chula Vista Elementary School District. Dr. Rosenale. >> Thank you. So this item is to request approval by the board to open up negotiations with our classified Chula Vista Elementary School District um classified employee organization.
073Our success this is for the successor agreement as the contract will be uh expiring in June of this year. >> Any board questions or comments regarding >> I have a question. Um, so I read all the articles, you know, the titles. Um, but what when they open negotiations, they're also going to come in sunshine what they want or is it all of these things that they need? >> The contract expires at in June 30th, 2026. So the entire um the whole contract? Yes. >> Oh, okay. >> Any other questions or comments from the board? I'm now opening the public hearing. Seeing no speakers, I'm now closing the public hearing. This is an action item. >> Move to approve. >> Second. >> Moved by Trustee Tamayo, seconded by Trustee Ramirez Dominguez. Recording secretary. Please call the
074vote. >> Ramirez Dominguez. >> I. Dominguez. >> Hi. >> Tolston. >> Hi. >> Tamayo. >> I. Motion carries. 5 Z. Conduct a public hearing on a general waiver request to provide a reduced day extended school year program from June 9th through June 30th, 2026 and authorize application for the general waiver request. Miss Casey, >> thank you. Each year we need to apply for a waiver or CDE so we can run a three-week program. This is a four-week program based on our year rounds calendar. So that's what this public hearing is about. >> Any questions or comments from the board? Um just double-checking that I know this is more of a transaction. Um it happens every year but just making sure that all the hours that need to happen will be happening during these two weeks.
075Is that what you three weeks? >> Three weeks. Three weeks. Okay. >> Yes. All the we have to maintain the hours that are required. >> Okay. Motion to Oh, I don't know if >> Okay. Any other questions or comments? I'm now opening the public hearing. Seeing no speakers, I'm now closing the public hearing. This is an action item. >> Motion to approve. >> Second. >> Moved by trustee Ramirez Dominguez. Seconded by trustee Tomo. Recording secretary. Please call the vote. >> Ramirez Dominguez. >> I Dominguez. >> I Tolston. >> I. Motion carries 50. >> Administrative action items. Item A 128. Adopt a resolution of the board of dire board of directors of the Chula Vista Elementary School District Public Facilities Financing Corporation appointing officers and taking related actions in connection therewith. Dr. Reyes. Okay. This a
076this is a yearly uh um action item that we need to do after the board selects the in December the president vice president and clerk and so this to uh have the new signatures. Okay. Any We don't have any speakers. Any questions or comments from the board? >> I I just want to confirm that like it just says uh Lucioarte will remain chair. Is it because you're the president and is that like it just follows suit. >> Okay. Yeah. Just wondering. >> Thank you. >> Action item. >> Move to approve 12A. >> Second. Moved by trustee Tamayo, seconded by trustee Tolston. Recording secretary, please call the vote. >> Dominguez, >> hi. >> Dominguez Tolston, >> IO. >> I motion carries. 5-0. >> First and second readings, board policies, administrative regulations, and board bylaws. 13A. First
077and second reading, possible revision to the proposed revisions to board policy 4113, personnel certificated personnel assignment. Dr. Rosendale. >> Yes, thank you. This board policy addresses personnel certificated personnel assignment. Um it addresses the district's obligation and authority to hire and to ensure that all um employees have appropriate certification. Any board questions or comments? >> To be clear, were we not ensuring that they had the proper certification? >> It's a revision of the policy. So, I think some new language came from EDC code or the um >> Thank you. >> Any others? >> Move to approve 13A. >> Second. Moved by trustee Tomo, seconded by trustee Ramirez Dominguez. Recording secretary, please call the vote. >> Ramirez Dominguez. >> Dominguez Tolston. >> Tamayo. >> Iard. >> I. Motion carries. 5-0 13B. First and second reading. Possible revision
078proposed revisions to board policy 4132, 4232, and 4332. Personnel all personnel. publication or creation of materials. Dr. Rosendale, >> thank you. This uh board policy addresses the publication or creation of all materials and ensuring that we are um we are in accordance with state and federal guidelines. >> Any questions or comments? >> I I do I have some questions. >> Okay. For instance, on page one of two, when you go to the it would be the third paragraph, I'm sorry, it comes across like CVE owns a teacher's brain. Of course, they're going to learn some things that happened in their course of work. You know, just developing curriculum, just developing some not every teacher uses the same styles and such. So it seems to me rather restrictive that if a teacher develops something by also
079using acquired skill set or acquired knowledge is now punishable by what? >> So Miss Rosel, could you explain can you share with the board uh the premise of this board of this board policy? I know we had it we've had it I believe since 1990. It's a revision uh and and where we get the revisions from and why why the changes. >> So So yes, it was updated last in 1990. It's been some time. So as um recommended by Fikmat, we it was requested or recommended that we go through all our board policies and and revise. So after review, um taking a look at um other board policies of other districts, um uh consulting with our attorneys, um revisions have been made. And so yes, um when teachers are creating materials, um there is um
080some district does have a responsibility to to that what is created to the materials that are created. Um, we ensure as the district that we teachers are creating materials to support their instruction and their learning in the classroom um to ensure that it's standardsbased and so the district is liable for the materials that are provided to students. >> I'm not sure that that makes too much sense. So if a teacher creating material because a lot of them I've spoken with Miss Rosie before they create and kind of even adlib and add to what the curriculum they're given and so now we own them because they created it in the that capac it just doesn't seem right. It it seems to me rather restrictive. they teachers then can't do I I'm I'm reading into this that
081are you're thinking that teachers are doing side jobs is that what we're doing >> so so what it says here is that during normal duty hours >> right but anything that they jointly developed using some combination of district time so or resources so I guess >> so so for example if uh there's uh two teachers getting together during collaboration time and they develop something that could be published or where there could be royalties or uh that that that because it was done during uh according to the board policy. If it was developed during normal duty hours uh then then it would be >> uh districts. >> So after school doesn't count >> duty hours. Yeah. >> Okay. So whatever the normal hours. >> Yeah. So if they had a bright idea right before the bell
082rang, it's theirs, >> right? It was >> if they work on it uh off hours, right? So >> we can have ideas and create materials, but it has to be after hours. >> Okay. So >> the problem becomes when they start working on them during the school day or the school hour. If you look at the last sentence, uh it says the district may not claim the right to receive any such royalty or compensation >> uh unless the materials were written or prepared during the normal school day >> while the official was required to be on duty. >> Okay. So if if it's during your So you can't it's almost like double dipping, right? So you can't work on and develop something that you're going to be gaining from during work hours, but if you
083develop it on a Sunday during on your own time, that's yours. >> Well, that makes sense. I'm just wondering, was our CVE uh union leadership consulted in this so that the language is there? I I understand what you're getting at. >> Okay. But I just want to make sure it seems seems kind of scary, but I understand what you're saying as long as it's really clear here that it's during school hours. >> Yeah. So, he actually says it both ways. >> During and then >> unless is. So, it's both ways. Yeah. >> Was this an action item? >> I didn't get my question answered. Was this CVE consulted? >> Oh, she nodded. She nodded. Yes. Thank you. >> I thought you saw. Sorry. >> She She smiles periodically, so I don't know. So, >> move
084to approve 10. >> Oh, sorry. You have a question. >> I I just thought of a question, but I just want to make sure I can ask. Um, is this also for the IAS and our, you know, behavioral people? We heard about how we're developing all these programs and courses and things for the benefit of the children. So I was just wondering if it's only for teachers or is it for every staff >> member school official. >> So I'm assuming also that CBCO was agreed to this. >> I I don't I think I believe we need to connect with them. >> Oh, interesting. >> Should we should we hold on this one then until CV Yeah, there's no rush. >> Yeah, you can wait. >> So, do you want an opportunity to consider this a
085second read? >> We'll do a second reading. >> Okay. Next time. >> Good. >> Okay. >> Thank you. >> So, hopefully CBCO will take a look at it. Let us know. >> And AACV, >> same thing. >> While we're at it, why not? >> All right. First and second reading 12. This is 13 C. First and second reading possible adoption board bylaw 922 resignation and that is Dr. Reyes. >> Correct. So we um so there's a board policy committee and uh uh we've been receiving uh board policies from the board policy committee uh and this is one of them. This is a new board policy and Mr. Tomayu. >> Sure. So, as we continue with FECMAT uh recommendation to review all water policies, uh not only the operational ones, but also our own bylaws. When
086we looked at uh CSBA's uh templates, we saw that many of our um board policies either are missing or have not been updated since 1990. Uh so, this is a revision. Uh well, this particular one is a brand new one. Uh it exists on CSBA's uh templates, but it doesn't exist in our um board bylaw book. So, we're bringing it forward for your consideration. Uh it's the language that CSVA has offered. >> Questions? >> Um just making sure we're not breaking any law by not having this to start with. No, the the the laws basically because every everything that is on the bylaws is meant to be government codes or education codes. If you look at the writing, a lot of the language here is referencing education code or or government code. We're just caught
087off codifying that. That way members of the public or uh board members don't have to research government law or education code. So they can just reference uh the board pylon. >> Okay. Just making sure. Thank you. >> A good question. >> This is an action item. >> Move to approve. >> Second. >> Moved by trustee Ramirez Dominguez. Seconded by Trustee Tamayo. Recording secretary. Please call the vote. >> Dominguez. >> I. Dominguez. >> Hi. >> Tolston. >> Hi. >> Tamayo. >> I. Motion carries 5-0 13D first and second reading possible adoption board bylaw 9224 oath of or affirmation Dr. Reyes. So >> this uh falls to falls into the same category where uh this is regarding the oath or affirmation for new board members whether appointed or um elected and again it was brought by uh
088the committee Mr. >> Yes. Similarly, uh this is another board bylaw that uh we did not had codified in our bylaw books, but it is codified in CSBA's templates and other districts have uh a similar um board bylaw as this one. Um it's entirely new. So that's why everything is bold and underlined. And basically it talks about uh how the process should be when um on boarding a new board member. >> Questions? >> Yes. As I was saying earlier, I had brought this to the superintendent's attention before I was first sworn in in December of 2022. And um I called out that the education code read this. So for corrective measures, can we ensure then that I I looked up the code, the ED code, I called CDE, I've called the state and um I
089was told in fact we were in error if if we had not taken the correct affirmation, oath of uh um affirmation. There is a ceremonial affirmation which is just that. When I initially was going to uh be sworn in, I had asked if my pastor could swear me in. But then um at the state level, my contact said no, they can only do the ceremonial and instead he did an invocation. And a board member from Sanicedro swore swore me in at the time. There's only certain people that can swear you in. And that I would suggest that that's called out here. Um maybe not everyone looks at some of these government codes. >> It is called out in administration oath >> first page uh second paragraph. >> Okay. But it uh it calls out I
090understand what you're saying and but it calls out also there's the uh public notary is also qualified to uh give the oath of office and uh even principles. So I think if we're going to quote some of these maybe we should a complete list. It's um it's a list and it says or any other official authorized under education code 60 or government code 8205- uh to 8206 if they want the full list. >> So two more people is too much trouble. >> It's not the the amount of people that the the problem is is that education code can be modified at any time. So we don't want to modify it. Uh if they decide to add uh the state superintendent of education or somebody else. >> Well, actually they they are also included in that
091list. Correct. >> An example, right? Um or or if somebody else that it's not on these list, that way we don't have to modify it as often. We put a u a list of who is immediate and it's similar to what uh CSBA offers on the template. Um this is something that has been vetted by CSVA. Um it's similar language. Um, and I get that it's two more, but the idea is to have it broad enough that if government code changes or education code changes, it doesn't necessarily trigger a immediate update to the board policy. >> And so the reference would be government code 1360, >> what you're saying. So may I suggest, may I recommend then um because it's not called out here. That's why it's important because if >> it's on the first
092page, >> right? But it's when you're identifying these. >> Okay. >> That's my suggestion because if it if if it fell off the planet before, we are not going to be here forever, >> right? >> Yeah. >> I hope not. >> No, me either. Thank you. [laughter] >> This is an action item. >> Move to approve with the addition of government code 1360 under administration of oath. Second move by trustee, seconded by trustee Dominguez Arvantes. Recording secretary, please call the vote. >> Ramirez Dominguez, Dominguez, >> I teno, >> I. Motion carries 5E. You have to keep in case I skip one. Um, first and second reading, possible adoption board bylaw 9124, attorney. Uh again there's a new a new board policy that uh the committee brought forward. Mr. Mayo, >> thank you. Similarly, um there's
093it's um it's another board policy that we're missing in our B board bylaw book uh which calls out the attorney and how uh the board can access attorneys and retain attorneys. Uh while we have had the practice of doing this, uh we don't have it codified specifically on a board bylaw which makes it more difficult to the public or to the board members to be able to understand the process. So we wanted to be transparent on this and bring uh forward something that CSBA is recommending based on the direction of FCMAT uh with this board bylaw. questions I do. So in abstensions where it says u it would be the second sentence when a member abstains because of a conflict of interest or for any other reason his or her abstension shall be considered to
094concur with the action taken of the majority. So, do they I'm I'm not sure. Do does the board member have to say why they're abstaining? >> Yes. >> And do they say why? Like I'm I'm I have a obviously they're obstaining because there's a conflict of some sort, but because >> that's my brother that we're hiring or something like that. >> So So you don't need to go into detail, but you can say there's a conflict of interest. There might be a potential conflict of interest. for example. Okay, >> you don't need to go into detail of, you know, brother, etc. >> And to be clear, I know I saw this occur at the city council where uh an indiv one of the city council persons abstained and they did not understand that by abstaining,
095they were agreeing to the motion and then they did then they did a doover, you know. But so I want to make sure that we are very clear that when we abstain the the repercussions of that. >> Yes. >> All right. This is an action item. >> Move to approve 13E. >> Second. >> Move by Trusty Tolston. Seconded by Trusty Tamayo. Recording secretary. Please call the vote. >> Ramirez Dominguez. >> Hi. >> Dominguez. >> IO. I >> I motion carries 5-0. Item 13F, the first and second reading, possible adoption of board bylaw 9251, censure of board members. >> And there is >> yes and again this new board policy. We do not have it even though it's on there's a process through ED code uh and uh the committee brought it forward. Mr. Tomayo. >>
096Yes. So there there's uh several board bylaws that talk about the the potential censure of uh other board members. However, one of the important pieces that is been missing is what is that process and what is the rights for our for one board member to respond in in case that's happening. So, in guidance with Figmat and um the CSVA templates, uh we're proposing to adopt the CSVA template as is >> rather than having to create one code. >> Well, it's b CSVA templates are based on ed code. Um so, and you'll see the the legal references and the cross references for for both. How are these board bylaws um substained? Uh I I we do mention that we're based on the 2024 edition of the CSBA professional standards. Um but this is uh one of
097the important pieces that is missing because you want to have that process. There's references to it in other BOR bylaws, but the process is um not there in our BOR bylaw book. >> Questions? >> Yes. So I understand um if the sole purpose of censure is to make sure there's no disclosure of confidential information. My issue here is who will determine what is or is not to be said other than the confidential information? >> The board. So does that mean that the so four people or three people out of the board need to approve it because it says that um I can complain about and that's my question. Can I come up and be like I need to I have an issue with Miss Dillia and she said something and I just don't feel like
098I like what she said. Can we censure her? And if you three agree we're going to censure her. Is that what >> we have to follow the whole policy like there's a whole procedure. >> Let's say we go through that. But if at a moment in time in a meeting I feel that her comment wasn't up to what >> I was comfortable hearing then I would bring it. We will go through the process. So depending on how I feel that day >> you need three you >> I would if I got three votes for that I convinced all of you that she was rude and now we're we're going to shut her up. Is this what you're saying that we're going to approve? >> I do want to clarify something that you said right now.
099>> Yeah. >> When you said I'll convince uh other two that would be a violation of brand act. So >> if I if I bring it up and I say I go through the process there needs to be a vote >> and at that day I let's say I don't talk to anybody but I go through the process and >> I talk here you can hear it. I'm not telling you to cover. >> It's not the if you look at the the process and you look at the things that you can be censored for. It's not just the way you're feeling. You have to provide evidence and you have to investigation. Yeah. And there would have to be a lot it's a lot more than just how you're feeling. You have to have evidence. There
100has to be different aspects brought before the board. So, it's not an easy process. It's it's a it's a very detailed process. So if you look at limitations, it says uh uh it requires investigation by the district supersedes applicable law including but not limited to the Brown Act. Uh so it does have so there is a process not about uh personal action but it's a statuto action. >> It's not something insignificant. Well, one of the important things that I think this board bylaw states and and I think that is the the wisdom of CSBA is that censure shall not be based solely on difference of opinion, lawful dissent or minority votes or protected speech under first amendment. Those are things that I mean we can have disagreements here and we often do but that doesn't
101mean that because I have a disagreement with Lucy I'm going to next time bring a censure vote or consider a censure vote um because of that there if I have a disagreement or I think that it falls under the grounds for censure because it's very specific um then I would have to get somebody else to second that before we can bring it here. Right? And then there's a process and the process is outlined there that uh depending on on the situation, it might warrant an investigation and also outside investigation or an investigation by the district to the to the allegations before we we bring it forward. And then censure is not just okay we're going to censure you is there's a couple things that it says that the board can do. We can do uh
102take no action on the matter. We can discuss it. We say you know what the the the findings we we don't think those are valid. So we take no action or we can say you know what we we think that this can be solved through training. um then that's a possibility that the board can do or they can adopt a resolution for censure which is the ultimate thing. However, one of the things that it does say that um it doesn't really um affect the the sensor board member rather than is a statement from the board saying that whatever behavior uh started this is not acceptable to the board. I understand and thank you for rereading it to me. Um, it's just that how would we know if who's going to police it? Like who's going
103to determine and what if it's used incorrectly? Can we bring it forward? Who's going to do that? Like I it can't just be a another board policy. Although it does have its its one, two, three steps, but it can be defined as anything else. And again, how are how are you how will you determine what's the difference between my first amendment right and you thinking that I broke a a code of ethics or policy standard or whatever else. And that's where my issue is. It's like who will police this? And what if the person that's going to police it is the one that feels that I wasn't acting right. So now it is to my detriment that we, you know, that we give the power to to do this to start censuring people. And >>
104let me let me clarify for you. Nothing precludes us right now from actually doing this because it's government code and it's legal code. So right now we could censure each other if we chose to do that and bring and do this process. What we're doing is codifying it for our board policy to say that we are going to uphold this policy. It's not nothing right now says that we can't censure each other. This is just making it board policy to put it into co to codify it for future board members. Doesn't stop us from doing it. So if we don't have this, we could still censure one another. >> So what you're saying is that we how is what is the process right now without this? >> It's all the legal ed codes that are
105at the bottom, but we've just put it all into a short document so that we can outline it without having to go back and look through all of the ED codes and legal and the government codes. And when you ask who who is going to police this, it's all us five, right? We all police this. When there's something there's a discussion, that discussion will probably happen in close session. At that point, there probably will be some legal advisor in there guiding us through questions, right, that we might have. Um, so it's going to be all five. It's not just Lucy or me or or somebody else, right? It's it's all five of us. >> Uh including the person that um that may be affected by this uh will have a a say on it. Uh
106obviously during the discussions we might have to separate that person but um they >> separate that person >> from from close session or from the discussion, right? Um there is a um it does say how um the person let's say that they're trying to censure me. um I get to be able to respond to all the allegations and I I will have the opportunity to do that um in in a written form uh that way is documented and but again the the way that this and all war policies get policed is by all five of us >> and I think I read somewhere that if there's a process of censuring that the person that is being >> me. Yeah. >> Yes. >> Let's say it's you. You get a lawyer. >> You can bring your
107own representation. >> Yes. >> Who's going to pay for that? >> I am. >> So, it would be a cost to the person that's been that is censured >> or tried to. >> Yes. Unless my my lawyer wins, then the district will have to pay for for lawyer fees. >> So, if it's if it's I bring my own legal counsel, we go to court. Is that what you're saying? >> No. So, okay. So, so trustees because I actually had a conversation with the attorney regarding this. the the attorneys represents so they cannot they represent the board but not individual board members. So for example they represent you as a unit but not individually. So if you choose one of you chooses to bring your own legal representation that's your choice and you you you would
108be responsible for payment unless you request let's say um truste requests hey listen so there's this situation I'm requesting to the board that the board authorizes payment for my attorney for my legal fees and then you as a body would vote and either ther approve or deny the request. So it would have to come forward to the board and then you you you approve or or deny the request. >> May I? >> So you pointed out that the attorney doesn't represent us individually but as a group. Does that mean they don't represent you either as a person? >> Individually. They does not represent me individually. He represents me as a superintendent for superintendent that anything that may impact the district. So if there's any correlation to anything that uh I'm doing or working that may
109affect the district, then yes, it would it would uh uh it would represent so I would be able to use it. However, as individually, if there's an issue that I have individually, it fall under the same guidance as any one of you. So, so for instance, I asked multiple times to be able to speak to legal because our policy said we have to go through YouTube and I did and I never got a response. So, how is it going to happen? >> So, you wouldn't be able to speak because uh the board policy that you just approved uh states that the the person that has authority to speak with legal would be the president on when you get voted. If you get voted as president, then yes, you would have the the >> So essentially,
110President Ugarte reigns over us. >> No, but I've brought legal to close session multiple times. >> No, but I've asked to speak and to speak to legal and you've ignored my request. >> It's not been it's been it's not been ignored because what it is is as a board we're only 20%. We we our employee is a we are a group employer of Dr. Reyes. The the standard policy is that the president in matters goes to the attorney and asks the questions and does the that work. >> Right. But my 20% counts >> and and I've brought the attorney to close session in in matters that become difficult. I bring and that there are legal questions. I've brought the attorney to close session. multiple attorneys, >> right? But to address some of the issues that
111I had, which I for instance, I asked that, no disrespect to you, Dr. Reyes, I asked that Dr. Reyes be on uh put on admin leave and I no other I only sent it to you during that investigation that that merit it me speaking to legal even with you present. I'm not hiding anything. You guys all know me. I say everything out there. I don't hide anything. And you guys can remind me if I danced on a table sometime and I forgot to fess up to that. I'll just remind you that it was a desk, not a table. >> And and yeah, I know and I know what you're saying and we need to stir this conversation because that would have been an appropriate conversation to have during the other policy, but that's not this
112policy. This policy is strictly censure and our process for that, >> right? But it it's connected because you're going to and censor me for saying what I said. >> No one's censuring you. >> Okay. Thank you. I would like to have the portion that Dr. has just mentioned that there is a way to solicit that the person who is being tried gets legal >> so >> advice because you just mentioned that >> so that is that would be under the attorney's >> policy >> but isn't this policy >> it says right here did you want to say So, so okay on on the so >> it says nothing in the section limits the effect of board members the right to be represented by legal counsel at their own expense but you just mentioned right now
113that if that person per se say Mr. Tamayo >> comes forward and says I need to find my own legal can you you know can you provide that that that would be come to a vote so right here in this in this statement it doesn't even give that option so again I want to make sure that our bar board policies have everything that needs to be written written so there's no >> you know misinterpretation >> so what I would suggest is that we don't take a position on this today. >> That way we can look at your request. >> That's fine with me. >> Trusty tomorrow. May I brief for you also is on page 204 the third line since censure shall not be based solely on those. So I don't know if that plays
114into what we're talking about. >> It does. I mean and that's why it's there, right? Because censure has to be something substantial. It's not just I disagree with Lucy or I or I I lost a vote and now uh because I voted with the minority, the minority is going to censor me. Um or it's under the freed freedom of speech, right? Um those are very broad in my opinion. So to bring a an element of censure to a board member, it has to be something really substantial where there's a significant documentation. >> And you said this is verbatim from the CSBA CSBA. This is law. This is what all the other districts. >> This is rules with all the districts. >> I just want to make sure that again if it's there's a possibility, we
115don't leave it up to interpretation. Um and I understand that it must be something relatively big or really big in order for be censured. We would hope so that that is how this is going to be used. But at the same time, I repeat, and I will go as a broken record. Let's make sure we put everything. >> You said you spoke to the attorney and and the attorney said that that's a possibility. >> What's the possibility? >> That the effect of let's say they're trying to censor me. I can ask for the district to provide legal and then that would generate a uh board agenda item that we would need to vote >> and that's for so anytime you want to seek legal uh related to this work >> right related to the work
116>> related to this work then uh you would you would have to bring it forward uh for it's usually you bring it forward for reimbursement. So so that's usually the way it works. you bring it forward, the the board says yes, no, and then depending on that, then you move forward. So, just say no, it is uh uh I can double check I can double check with a with a attorney in regards to because I'm sure there are some things that are that you can't pay and some things that you cannot pay because of of u possible gifting of public funds. So, I would have to check with attorney with a with a I hear what you you're saying, Trusty Ram Dominguez. Um, >> so let let me take it back and and >> yeah,
117>> look at that. >> So we can do is I'll bring it back, take it to legal, ask those questions. >> We'll revise it. >> Sounds good to me. >> Thank you. So is this considered a first reading? >> First reading. >> First and second re um item 13G. Item first and second reading possible revision board bylaw 9005 profess professional governance standards. Uh similarly, this is another uh board item uh board bylaw that uh needed some updating on the language uh based on the revisions from CSBA uh where we make more clear are between our duties, the duties of the uh superintendent and also our professional standards. Um, next month I'm hoping to bring you another uh from the committee another 10 uh board bylaws that need updates. Um, and some of them, like I
118said, they're they haven't been updated since 1990. >> When my grandson was born. >> Yeah. >> Questions on this one? >> This one's re re >> Can't talk. Sorry. >> This is recent. I I just saw that it was revised in 2022. Um, again, it actually includes censorship here. Censor I can't say that word. I'm sorry. >> Censorship. Yes, I can say it. Um, it it's included in this area. So, if we're going to try to, you know, make sure every detail is concerning in that area is correct. I would also make would like to ask if again anything that has to do with censorship um be be brought back um that was one thing and then the other thing um we scratched where is it I'm trying to find it um about how as
119board members we can are we going to strive to learn more and have more um trainings. Where is it? Participate in professional development and commits time and energy necessary to be informed as a as an effective leader. Um and then participate in professional development and commits time and energy necessary to be informed. Oh, it's twice. Just kidding. Um but I just felt like the new wording is very big again and it just says Oh, where'd it go? that it it it's just it's it's vague. Um it doesn't like state how important it is for us to continue learning to become better leaders or participate in professional govern um governance standards and other things. So I was just wondering why it went from a very specific topic to just a little >> it it just got
120moved right because it went under board development. Um, it recognizes that the board needs continued learning to strengthen government. So that's page six. >> I have a question about this one. >> Sure. >> Um, professional governance standards. Obviously, it means kind of how the board carries themselves or how we carry ourselves with um with the staff and everybody else. I know that we've discussed before and I don't know if it falls under this bylaw, but um where um any anytime an administrator or a teacher reaches out to us to to go visit a school or anything like that, they should go through the superintendent's office. Um so I don't know if that can be it can that be put in here. Is that a part of government code? Because I know we've been told that
121before. >> It's up to you. It's up to the board. >> That's part of our board policy. >> Is it part of a policy already? Okay. I just wanted to make sure. So, are you asking to >> um Well, just make sure that everything that has to do with censorship again is >> this one for the next update. >> Good for a second read for another read for J. >> We can do a second read. There's no rush. >> Okay. Thank you. I'd like to take a 10, >> but there's there's no sorry, just for clarification, there's no change. You're just asking to wait for a second reading, right? >> Um, just to again make sure that everything is consistent with what we're going to talk about in the previous censure bylaw. >> Um, and
122that it's written if it needs to be written. >> Okay. So, yeah. >> Okay. Clarification. So, this one is fine. Just revise the other one, making sure the other one is fine. So, it matches. Yeah. Since the other one needs >> edits, I want to make sure that whatever is written here matches the other one because we're talking about the same thing in two different people. >> So, we're still calling it a first reading because we need to confirm the two. >> Yes. >> Thank you. >> I'd like to take a 10-minut break. Okay. Item 14A, general information items reports report on the governor's 2627 state budget proposal. Mr. Pong. >> Thank you, President Ukarte, members of the board, Superintendent Dr. Reyes. Tonight we have for um your information just a very brief report on
123the governor's proposed budget for the 2627 school year. Just a very brief economic outlook. Um in terms of the US outlook, the uh gross domestic product continues to grow. Inflation is slowing and consumer confidence is slightly up. However, at the California level, um economic uncertainty uncertainty still remains um as the stock market gains are driven by a few technology companies. So, the state really relies on the top 1% and how those uh the 1% performs um financially. A lot of it comes from the stock market. Um so, all of that remains uncertain. Um currently we'll have more information about um what they're looking at from stocks. The governor uh presented a balanced budget for the current year or for the 2627 school year but then a deficit of 22 billion in the 2728 with shortfalls
124continuing in the two subsequent years. For our cost of living adjustment, which is increase that we received at the from the state, we're looking at a decrease from what was previously projected at 3% down to 2.4% um in the first year uh 3.4% down to 3.1% and then about the same 3.3% in the third year. They are proposing um an ongoing funding for special education and the district reserve cap um is going to likely be triggered in 2627. In terms of one-time funds, they are proposing onetime funds for professional development to support professional development um in the areas of English language arts and mathematics frameworks, teacher recruitment and retention efforts. They're also proposing to restore the remaining amount for learning recovery block grant through 2728 for our expanded learning opportunities program. They're proposing for the
125tier two. We're in tier one um which is a higher level, but we um there's a possibility that the district could fall down into tier two because we're kind of on the border. Um the border the qualifying unduplicated is 55%, the district is currently at 58%. So they're um proposing to bring this to a stabilized tier amount of 1,800 per student. In terms of transitional kindergarten, we're now fully implemented. There's no additional relief for the Stirs and PERS retirement systems. In terms of risk to the state budget, uh we're looking at a $22 billion deficit again in 2728 and shortfalls into the future. in terms of the stock market volatility. So they're kind kind of co coining this the either AI bubble or AI boom. So um either those stocks are going to continue to
126increase or it could be a bubble like the dotcom bubble and it could burst. Um so that's um the very big factor in terms of the stock market at the federal level. Policym is uncertain related to immigration and foreign trade. of the tariffs um inflation volatility and how the federal government responds to that volatility remains uncertain. And then on the nonproposition 98 side, so the non-education side of the budget, they're really seeing increased costs and medical costs um putting pressure on the budget. So in terms of a district outlook, um the district does have a structural deficit. So that decrease in the cola is going to um also decrease the district's revenue. Um in the first year we're projecting about 1.4 million um in that just a decrease of the six uh percent. And then
127we have our costs that are just continuing to rise. So as we look towards our reductions um for next year, we we still need to look at uh continue to address our deficit. So for next steps and timeline, we're awaiting the the governor's May revision next. So over the next couple of months, the Senate and Assembly will have their hearings. Um the governor will issue his May revision on May 14th and then the um the two legislators come together with the governor to agree on a budget proposal. So, with that, I will open it up to any questions. >> Thank you, Mr. Pong. Questions? I do I'd like to see if um Mr. Pong could elaborate a little bit on what's happening with Prop 98 and the gutting of it essentially or kicking the can
128down the road and the effect that the trickle effect it has to us directly. So, right now they're looking at a um they're calling it a manipulation of Proposition 98 um where they're artificially lowering the the Proposition 98 guarantee which would affect future year calculations of the Proposition 98. So, um if they lower in the one year, then there's a future impact of it being lowered each and every year after that. So, um they're trying to count um a different fiscal year's money towards towards one year and um really that's not appropriate accounting. So, that's why they're calling it manipulation of the Proposition 98. >> And I understand that CTA and at the national level are really up in arms over this manipulation of Prop 98. It has a direct impact on our services here
129to include sped So, everyone's up in arms except for the state that wants to make it look like we're okay. Is that correct? >> Correct. >> Thank you. >> They even called it unconstitutional. >> Very concerning. >> Um, >> as it applied Oh, sorry. >> No, no, go ahead. Go ahead. as it applies to us. The 6% uh reduction in cola, how much is that going to lose for our revenue? >> It's about 1.4 million.4 million. Do we need to make adjustments to our request to reduce 6 million? >> Right now, um we'll be working on that 6 million. So not right now but in future years we'll have to continue to address the deficit. >> Okay. >> So that just means if we don't gradually do it then there comes a year where we
130drastically >> drastically dwind it. >> Okay. >> Anywhere else? Um on the May reby it's still up in the air or is it most likely going to be less? >> There there have been changes between the January and the May and even the final adoption. So um we usually um budget based on what we know currently. >> Okay. And for that Prop 98 issue, if changes, it would have give us like let's say they funded they it would give us more money, right? Or not this year at all. >> Uh it would. >> Okay. >> Hopefully. >> Overall education. Yes. >> Sounds good. Thank you. Any other questions? Okay. 14B. Report calendar to the board of education. And this is the point in the agenda where board members can ask for reports from the superintendent
131trustee Ramirez Dominguez. >> Um I would like a report well the one that was talked in close session. I don't know if I can say it. The one for the settlements >> we can't we can't. >> Okay. Yeah. Just wanted just wanted to know if that stays over there. I wasn't sure. Okay. Um also I want to report please on how uh many if I can have a chart of the approved travel that was less than I think it's a thousand or what is the threshold >> 2500 um the approved travel uh that was less than 2500 in the past >> six months please >> six months or since it was approved >> well since it was approved since he offered Is that all? Is that that all? >> Sorry. >> Yes. In regards to
132reports, could I ask that we get an update? I know you have that the we have that running board Friday update. I think some of them may need to be tweaked a little bit to let us know if there's new information or uh if they've fallen off already because it's been it's a done deal. I think some of them are still running on there and they've been completed. >> Okay. Yeah, I purposely left them there just to >> Well, then then maybe that's a good idea that >> we'll inform you that inform the board that >> completed >> that was done. >> Okay. Well, maybe that is a better idea. So, don't ask you for it again. tell me it's there. Okay. But um I do want to resurrect again the um the request that
133for uh Trusty Tamayo and I have asked multiple times for uh the students and we can call it whatever we want but they're falling through the cracks when they are not at the state standard. And we already all know that the California standard is quite frankly is even lower than a lot of the states. So what are we going to do to support those children? And um and if possible, maybe we take a look again at some of this Title One money to tutor them. I I just can't I can't fathom the idea for us to continually promote the children that are not ready to be at that next level because they're not there. It's not their fault. It's a combination of the adults providing the support that they need. So, if we could please
134get a deadline on that so we find out where the kids the children are. >> So, so can you be precise on the on the >> give me a report of what kids are failing. below standard. >> Below standard, not approaching. You don't get second place here. You the pass or you don't. That means the children are not where they need to be. And it just snowballs for then the teachers to be able to teach that grade level curriculum. You heard before we that first grade to 11th grade readers. >> Miss Morales, and the presentation that you're doing next month, is that part of it? So, in the presentation that we were going to do last month, but is for next month, we'll do um a report that shows all of the district data in
135terms of like the dashboard data. >> So, a lot of that will be embedded. But in addition, in one of the board updates, I believe it was on December 12th, there is a link to a chart where it provides all of the CASP data that indicates where all of the students have fallen. >> All the students. >> Yeah. In the areas that are tested. >> Yes, I saw that. Thank you. But we we are looking for is each school. Each school what classrooms I think we wanted to get specific so that we could actually target that and what do we need to do. I pretty much donate most of the time my my stipet every month to whatever school whatever need that someone tells me about. I have no problem donating it to tutoring. Tell
136me what child can really need. All the kids can use a tutoring, but there might be some that are more challenging. Whether we send tutoring to their home, I don't care. Let's get creative so we can help our students. So m maybe if I may um >> maybe in the next month's report that you're going to do out here in public >> um not only can you tell us a little bit more about how many are failing in each school but what are those uh strategies that we're going to implement to help them right and how much funding do we need that way we can put real numbers to that effort right because well, thank you for donating the $750. >> 7-Eleven. Sorry, >> I forgot it's 7-Eleven. >> Yes. >> Well, it's 750 minus
137taxes. >> Um, so it's a real It's a real dollar figure in millions to provide these supports. So, I want to know how much because the public also needs to know that we're investing this money here, right? And I think that that will um help us as we transition to make some cuts to also provide some some light at the end of the tunnel that at least we're also all investing uh resources to help the the most needy students in in terms of learning. >> Thank you, Miss Jessica. Appreciate that. No, it's not I know it's not a small task. I do. One teacher can't 30 kids, 31 kids, and now we're talking about 29,000 plus. I get it. Thank you. >> So, so we'll do instead of a board update, she'll add it to
138the report. >> I just have a quick one. Um, a few months back when I went to Park View, we requested a review of a water uh bottle dispenser area that the principal was asking to see if it could be moved closer to the bottom playground. So, can we get an update on that? Did we get a chance to take a look at it? >> Did you bring a I believe you did an update. >> I know I asked about that a few months ago, too. >> Yeah. Um, so that one there's no water source out there. So it was >> she was asking to not for the bottom playground. She just wanted it closer where there is already a water fountain. >> Okay. >> So it's just that like the the bottle dispenser is
139way too far for the kids at the bottom and there's a closer uh water fountain where she they were hoping to have that bottle dispenser move that way. >> Okay. I remember us asking that I joked about some kind of a hose. >> I I know. I mean, you know, we would we would drink from it like get the kids some water. It's the summer's coming. >> I think that could, you know, that that's I'm in I know what works, but the innovative part is not here, but I know that everyone else has that innovation. Maybe there's some kind of thing that goes out there and shoots water. I don't know. You got you you know some kind of idea. Tamayo already has an idea >> right Mr. Right. Trusty Tamayo. >> I'm sure our
140new facilities person has ideas. >> There we go. >> It's gone. That's why I said this one facility >> job. >> Good thing the meeting's recorded. He can watch >> any reports. Report uh excuse me board communications member of the board of education communication to the public. Uh, starting with Trustee Ramirez Dominguez. >> Um, first of all, I would offer my condolences to the Hitfield and the Genevese family for the loss of their loved ones and pray that peace and comfort falls on their homes and their family members. Um, since we weren't able to share last month, I would just share a little bit of what I was able to do last and this month. Uh last month I attended the Starlight the Starlight Parade, Discovery Elementary, Castle Park Elementary, and Aoyo Vista. Um also
141I would like to apologize to Castle Park Elementary. They invited me to an event and I was gravely ill and I couldn't attend, but I'm sure it was amazing. Um I also attended the DAC dile um meeting and I attended the sensory processing uh parent engage parent um class that I was very surprised to see it was well attended and the parents were very participative. So I feel like that was to be very honest one of the best ones I've attended not only of the material but the parents were very engaged. So I feel like in that one it was like a gold star. So um that was really great. I learned a lot. Um also this month I attended Montgomery Elementary and the budget perspect budget perspective workshop where we learned a lot about
142what is happening with our budgets. Um and that is it. I hope to continue um to start off a great year for everybody and to continue to visit schools and to I am looking forward for this speech contest that I know it's coming up. So, I'm very excited. Thank you, >> Trusty Domingo Svantes. Just to recap, in December, uh my husband and I and this real estate group that works with uh educators, uh we donated a combination of a hundred um turkeys and gift cards and uh our principal there, Mr. Risa Paris, is an amazing uh leader there along with their communication their um community schools leader. Oh my gosh, they just had everything just made it so easy. Everything was organized and uh one grandma didn't want the turkey. She just wanted the the
143uh the gift card because she said she's vegetarian. So, I'm glad that we had a combination. So, that worked out really well. And uh we also um donated some uh toys. Well, play play equipment to uh Castle Park Elementary and um went to the DAC DAC meeting as well and Trusty Tamayo and myself attended a parent meeting at Ellen Elementary and um just want to let everyone know that we're always available. Just reach out, send us an email, see what we can do to help. And also attended the January budget perspectives uh workshop yesterday. very informative. I really like to always have a better picture and I do understand the struggles everybody has. And uh I think that's it for right now. Thank you very much. And I also want to send my condolences as
144well to um Mrs. Espedansa's family and Miss Darcy's family. Darcy. Um, Langfeld was my granddaughter's teacher and my grandkids never went to a single field trip without Nana. And so I was always volunteered to go and uh my kids don't understand how I could be a cool Nana. But when you're nana, you don't have to have as many rules. And uh the kids used to want to come and be in my group. And um Miss Darcy made it a wonderful experience for my granddaughter and I know her kids too and that's just no words for that. So our condolences to your families. Um also my condolences to those two teachers, Mrs. Pansa and Miss Darcy. Um obviously when you suffer a loss it's unexplainable what you go through. Um, also I know that there's been
145some parent losses these past few months at my son's school. So those families are on my mind um firsthand knowing what it's like to lose a to have your son lose a parent. Um, on a happier note, we I had the opportunity to participate at the Starlight Parade. Um, again, congratulations to every single person that participates in that. It was nice to see so much unity within the district. And interestingly enough, I had the opportunity to visit the Maxwell Transportation Center before before the Starlight Parade. Um, and Mr. David was around here somewhere. Uh, just to see the the harmony. You can tell I always say it. I can see how staff just enjoys their jobs, enjoys what they do. um they're explaining to me it was amazing to see the operation the logistics that
146go into seeing a a a bus you know you just again we take it for granted as parents and we see them on the street um so that was just very eye opening and you know I was telling some of that staff that you know they're explaining some things to me and what I loved seeing is all their little trinkets I I don't know how many little buses toy buses Lego buses everywhere every single office had. And from that, it's just a quick story. It's so funny because I'm going to find out the number of this bus. We lock eyes every morning when I'm making a left and he's making a right to Lane towards Lane Avenue and I'm making a left that way and I'm like every single morning at the same time like
147it's just amazing to see and it just always reminds me of all the bus drivers. So, I just wanted to thank them for what they do and um I'm looking forward to more visits. Trusty, may I interrupt you before I I don't want to minimize another concern that was brought to my attention to and it it was brought before the um earlier with public comments uh the um decisions and I'm just I know that it belongs more in the reports but the seniority pro uh process that creates ine inequitable outcomes across our district. Some schools will retain the mental health professionals they have invested in while others will lose them. And this is not based on need or effectiveness, but due to an inflex an inflexible seniority structure. I know we had a discussion before
148about the seniority structure. And there's only certain things that we can do. But I just wanted to voice u some of our staff's concern regards to social workers and behavioral specialists to see what what else we can do to maybe make that better. Thank you. >> Sorry to interrupt. >> That's okay. Um just want to start with uh happy new year everybody. It's the first uh meeting from for the year. So, happy new year. I hope that everybody had an opportunity to spend time with their families and disconnect from work because work is draining. Um and having to not only be at work, but thinking about work every single day can be challenging and especially during the holidays. So, I hope that you had time to to rest, to disconnect, to really enjoy your your
149family and and get connected to the to the why you you're here, right? To you're doing it for for family, for your loved ones. Um, and I hope to be able to participate and attend uh school events. Uh, I already received several invitations, so I'm looking forward to attending those. And that is it. Have a good night. I too want to wish everyone a happy new year. Um, and I do want to extend my condolences to um the families of CVE members who were lost over the break and anyone um of our our members our our teach our staff right and and our families because it's really hard especially during the holidays when when we lose u our family members. Um I also have received some invitations that um the principal is like I got
150to get you early. So, I I'm booked like into April and May. So, that's good. Um, and I I look forward to continuing those visits and interacting with staff as I'm down here at the district office and out at sites. Dr. Reyes, superintendent. >> Well, I want to I want to welcome everyone back. It's exciting to start a new semester. Uh, my condolences to those two families, but also to uh any employee or any family that is struggling with either health issues. I know we have several employees that are battling some uh health issues or someone in their family. There's different situations. So, I just want to uh let them know that, you know, we're with them. Uh also just uh thank like always thank everyone from cabinet to everyone that supports us to principles,
151teachers, classified, everyone that supports students and that are here every single day making a difference for our students. Thank you. >> The next regular meeting of the board of education of the Chula Vista Elementary School District will be held on February 11th at 400 pm for close session and 6 pm for ocean open session. Do we have a motion to adjurnn? >> Recording secretary, please call the vote. >> Ramirez Dominguez. >> Dominguez. Hi >> Tolston. Hi >> Damayo. I >> I adjourned at 8:38.
