Trader Joe's. >> Oh yeah. So did And now everybody's going Well, we All right, we are live, I believe. Thank you very much uh for getting that uh set up. Uh so, I'd like to go ahead and call this special meeting of the Dardi Unified School District Board of Education to order at 5:32 p.m. We'll quickly do roll call. Uh, board member Diaz >> present. >> Board member Finley present. Board member Hogin >> present. >> Board member Hasso >> present. >> Board member Reyes >> here. >> All right, everybody is here and accounted for. Uh, >> Dr. Can you hear us? >> Okay, we're good. Okay, thank you. >> Dr. Hassa, would you mind doing our pledge of allegiance? >> Sure. Please stand. Place your right hand over your heart. Ready? Begin. I aliance to

the flag of the United States of America and to the republic for which it stands. One nation under God, indivisible, with liberty and justice for all. All right. Next, we'll go ahead and move on to the adoption of tonight's agenda. Do I have a motion? >> So moved. Second. >> Motion by board member Reyes, second by board member Diaz. Any discussion? Seeing none, all those in favor say I. >> I. That passes 5. Uh, next we'll go ahead and move on to the request to address the board. Uh, we have two cards up here. Um, so does it matter what order I go in? Okay. So, uh, we'll go with, uh, Miss Sherry Johnson. And we have, uh, three minutes. Someone have a timer. Would they mind timing? You need all the cameras up here

in front of you pointed back at you. >> And the last thing I need is a mic directly in front of me. So, um, good evening board members. My name is Sher Johnson and I am a teacher at Beardsley and I am also on DA. So, I'm here to speak about the construction at Beardsley and the possible removal of our garden area. Uh our garden area is very important to our students. We have several of our special needs students that that is their safe place on our campus. It is a haven for them. They go there when they are having emotional issues, outbursts. That is the place that they go and removing it would also remove that safe haven for them. It is also an area that most of our students go. It's quiet area

that they can go and write reflectively. We had uh kindergarten classes out there today writing, drawing pictures, and being able to write about the garden as they're learning to write. It's something solid that they can see and write about. Uh it is also a place that we send students to when they need time to reflect. It is a reflection piece for us and removing it removes that area for us. This is the first school I've been on in 27 years of education that they had a garden developed such as our garden is. It's usually just when they talk about, well, we have a garden, it's usually a flower plant area where they've planted some flowers and the kids go out and paint rocks and put them in there. It's not a fully developed garden. And

that is one of the things that as a DUA member u we campaigned for the bonds that went to pay for that garden. And we have never been asked our opinion about the construction of it or the removal of that garden. We have never been asked as teachers at Beards Lee what construction like what construction should look like, what the classroom should look like. As a teacher, I teach eighth grade math and science. I have zero cupboards or shelves in my classroom. I have at least 20 boxes of science materials that I do not have anywhere to store. They have to remain in the boxes, beers, other things that could be used for science material, science labs. I have nowhere to store them. They have to remain in the boxes because once I take them

out, getting them back to Jenga them back into the box is near to impossible. We don't have a dedicated science lab for middle school. So all of us are holding all of our science materials in our classrooms at this time, taking up other areas that we could use for students study rooms or anything else else like that. It becomes a storage area for our stuff because we don't have anywhere to store it. These classrooms that were built that the u the middle school is in, there was no teacher input in the design of these. I mean, literally between myself and the other eighth grade classroom, there's a glass sliding door, so you can actually sit in my room and hear instruction going on in the next room. So, having teacher input on any construction at

Beardsley is vital. Thank you for your time. I also want to draw drop these were actually for our board. >> Thank you very much. All right. Uh, next, uh, we have Vanessa. Sorry, is it >> Dark Dark >> Dearos? Okay. All right. Thank you. >> Thank you, Vanessa. >> Hi everyone. My name is Vanessa and I'm an eighth grader at Beley Academy as well as our ASB vice president. I want to talk to you about the rose garden and green space which means a lot to me and many other students at Berkeley. The rose garden is so much more than just a place with plants and or benches. It's where we hang out with our friends during break and lunch where we laugh, talk, and get a moment to breathe during busy school days. It's

one of the few calm shaded spots we have. It's also a place where the younger classrooms come out to learn on nice days. They read under the trees, explore nature, and enjoy the fresh air while learning. Losing this space to portable classrooms is really disappointing. It feels unfair that a decision like this could be made without really seeing what it means to us. It feels like we're losing a small part of what makes our school feel like home. The Rose Garden is one of the places that we can go to that helps us relax, connect, and feel part of something bigger than just classrooms. Now more than ever, we need spaces like this. Many of our teachers who we love and respect are closing their doors during break and lunch. And I completely understand why.

They deserve better pay. They work so hard every day teaching us, supporting us, and being there just for us. Not just as teachers, but as people who truly care. They are safe space and our home away from home. So when they have to close their doors to stand up for fair pay, we respect that. But it also means we the students need spaces like the rose garden. It's a place where we feel safe, where we can be together and have fun. Have fun. A calm, shaded spot where we can just be ourselves, especially on hot days. That's why I want to ask the board members and district leaders, please come visit our school during break and lunch. See what it really like. See how it's really like see how we use this space and how

important it is to us. It's hard to understand what the rose garden and green space means to us. If you only look at it on a map or from an office and if you must remove the rose garden and green space, will you relocate it? Will you make sure students still have a safe and welcoming area like this one? I truly hope whoever makes the decisions will think about what this space means to students like me. It's not just a garden. It's a symbol of togetherness, learning, and care. Please don't take away one of the few spaces that helps us feel safe, connected, and happy at school. Thank you. >> Thank you very much, Vanessa. All right, and I think we have one more. Uh, Miss Heather Mesner, you are up. Three minutes. >> Hello.

I will not take three minutes. I just wanted to come here tonight and and just remind you that throughout this process, the teachers, the students, the staff at Beardsley, we were not consulted. We were not like at any time did we give input on our spaces, on the classrooms, on the remodel. And I I'd like to and to remind you that every single bond that was passed, the district came to us, DUea, to support the bond, to canvas for the bond, to text bank, to knock on doors. We pushed for the bond. We helped pass the bond with the expectation that the process was going to be a truly collaborative process. Every single bond, we used our dues paying money. We got members out. We did mailers and and honestly, we want to stop, take

a pause, work with whoever the architects are, have the plans, give input, give input on our classrooms. Um, we're supposed to have a new art, science, music classroom, preschool classrooms. None of us have been asked what those classrooms would look like, what we need. Um, so yeah, I'm asking for you to take a step back, wait for our new superintendent to come in, present us the plans, let us give inputs, and do it the proper way. That's all I have to say. And yes, the rose garden, the gardens absolutely should not be removed. That was a part of the last bond, brand new, sustainable California growth, super important for the kids, safe space, learning environment. Uh we use those gardens for a learning environment all the time. Um, it's something unique about Beardsley and I

definitely do not want to see that destroyed, removed, half of it done. The park is great, but that is not a part of Beardsley. That is not the kids safe space. Uh, so thank you. >> Thank you, Miss Mesner. >> All right, I think that is it for public comment uh or sorry, the request to address the board. So, we'll move on now to item number six, which is um the amendment number one to lease lease back documents uh with Balfur Batty Construction LLC. The contractor for the guaranteed maximum price GMP for the construction for the Beardsley Dual Language Academy modernization project, the agreement. Do I have a motion? So >> motion by board member Diaz, >> second by board member Finine. Is there any discussion board? >> Yes, >> Mr. Reyes, please. >> Um,

first of all, the GMP gross maximum price. What is that? How much is it? >> I'll I'll have Miss Bell come up. It's uh >> I believe in the in the price there, it's 14. I know, but I'm asking a question now. >> How much is the GMP? How much is the gross maximum price? That's what it says here. That's what we're approving. >> Right. It should say how much it is. That's why I'm saying I can get it for you. Exactly. >> Please. Okay. I I can I can ask other questions while you look for that. >> The the the price on here >> it's 14,420,152. >> Say that again, James. >> 14,420,152. To me, that is a lot of money. A lot of money. Um, the reason the reason I'm asking, right, because

I I noticed that we're according to this uh that the architect gave me today. Um or the contractor. We're going to move we're relocate one, two, three, four, five, six, seven, eight, nine portables from Anderson to Bey. Am I looking at this right? There's the I believe it's um nine or 10 off the top of my head. How many portables? >> Two, three, four, five, six, seven, eight, nine. So, nine of them. And there are nine portables at Andrew awarding. >> We're moving nine portables. >> Uh yes, sir. There's actually more than nine portables at Anders. >> Really? >> Yes sir. So more than one portable is like or it's going to take more more than one portable for a classroom because I only remember in the where the kindergarten was one two three four

five six and then the ones out on the asphalt. Yeah. Seven though the ones on the asphalt needed to be replaced >> and and what they what they are doing >> they're in bad shape. So part of the the cost is them re-refurbishing the portables. They're not moving messed up portables to a new site. That's part of it. >> So they're going to refurbish them at Andrew Stardy. >> They're going to refurbish them at Pearson, >> but they're going to move them in the condition that they're in. They're going to move them. >> That is correct. >> And if they fall apart in transit, >> hopefully they won't. >> Oh my gosh, those things are messed up. Those things are old. Oh my gosh. Okay. And that's and that's supposed to save us money versus

purchasing new ones. >> That will save you money instead of purchasing new ones. >> And how much are we looking at saving? See, I I don't know any of this. That's why I'm asking all these questions. This was never brought brought to me at all. Okay. So that's why I'm asking >> the the cost and availability of a new portable is um a lot more than than refurbishing a portable that we already have >> and the availability of them as well. I do not have the price in front of me, sir. >> Okay. So we don't know how much we're saving. >> No, we do know. We just don't have it in front of us. >> If you have a list of questions, so you don't know. We can get that for you. >> Know

to make that decision tonight. >> We can get that for you. have that information. That's what I'm asking. That's why I wanted this meeting. That's why I wanted to table it so we could get that information to us. >> But but we do I mean it is a I mean would it be fair to say it's a considerable savings? >> It's a considerable saving over probably $50,000 per >> and you know somebody mentioned tonight about not being told not being asked. This is this is the same thing that happened when we put those portables up there at Royal Oaks. None of the board members were asked to see what these things look like. And by the time we got them, it was already it was a done deal. And and and I don't think that's

right that the community doesn't get it's their money. It's our taxpayer dollars. We we should have a say. Okay. And and what what was unfortunate is somebody mentioned about the classrooms and they're tiny and and the wall is all glass and oh they'll be able to work and they're never going to have to cover those windows and it'll be fine. It didn't they cover those things right away because of the distraction of the students in the other classrooms. And that's the same issue with bears that you go in there into the classrooms and same thing. They're all covered up. >> And uh >> um let me I'm I'm nuts. >> Sorry. >> And and the thing too when I talked to the science teacher at Royal Oaks, he's like, "I don't even have a sink,

Tom. I have to go out to the water fountain to get water to get anything." And and that that should have all been discussed and prepared and planned and it never happened. And the same thing is happening here with Beersy again, right? We're we're going to have these rooms and uh nobody's talking, nobody's asking for anybody else's input. It's just being done and I feel like it's th being thrown down my throat. Okay. And and uh it's it's just it's unfair. >> Well, there there have been meetings with the principal and the preschool um director, >> but what about >> and they have had input into what the community? What about a couple teachers on on that committee? What about a board member or two? What you know what about the people who represent or

are on the on the bond oversight committee? I mean I don't >> Well, I'm tell we we got it from the preschool director whose classroom is the setup and then we have another part of licensing that comes out and looks at the setup to make sure this is the way the room should be. So we did have people come and look. Not well I feel left out. Okay. And um and the other thing too is is that garden is beautiful. It's a beautiful garden. And um how much parking parking lot would we lose if we moved it over to the parking lot. >> If the buildings were put onto the parking lot, you would lose over half of the parking lot, which doesn't h would not have enough spaces for our staff >> really. half

that much? >> Yes. >> Yeah. I saw those tables and I I could see the kids using them and and I've actually seen them on there. Um the kids using them. Uh, and I just it's it's sad to see that something like that is going to be taken away from them because where where are we going to how are we going to replace that? Put that where where else would would it go? There isn't anywhere else on the campus to put something like that. >> Are we losing all the garden? >> The the back um threequarters of the garden would be lost. the front quarter the behind the large tree is where the buildings will be placed. So anything that is uh in front of the large tree is going to remain. >> All those

tables and and and benches are all gone. Correct. >> The tables that are in the back. Yes, sir. >> No, most of the stuff is is set in the back that I saw today is behind that line. >> Yep. I had the pleasure of walking every board member this week um by Beersley to show them exactly what the plans are and where the things are placed. >> Yes. And thank you for that, Mr. Crosby. >> I have a couple questions. >> Yes, please. >> There it goes. Okay. I think I made it too low. All right. So, the first question I have is going back to last week's meeting. So, I don't have my computer. I'm not texting. I'm using my my phone as a computer. Um, one of the implications for voting last week

and then moving this quickly was kind of the deadline and then locking in that GMP. Can you remind me what that deadline is? >> We should have if we would have voted on it last week. At this point now, we're like two weeks behind. Okay. the the project is supposed to be starting in uh November and then uh will end approximately right now in March of 2027. Um if the uh plans are changed, they're already DSA approved. And if the plans are are changed, they would have to go back to DSA DSA uh to uh for reapproval, which takes up six to eight months of time as well. Um so want to make sure that the board is knows that as well. >> Okay. Thank you. And for those three classrooms that are going to

be placed where the rose garden is are reminded through it, Rick, thank you for taking us. Can you remind me where those classrooms are coming from? >> Uh, those classrooms, sorry, I got a text message that I should talk in the microphone so the people out there hear me as well. Uh, th those classrooms are being refurbished and coming from Andre Wari. >> Okay. And then are there any plans or opportunity what are there like what amenities are going to be provided to the teachers? So, uh, Miss Johnson, right? Okay, Miss Johnson talked about her supplies and having no storage for them. Heather, >> these classrooms are not the same as the Gen 7 classrooms uh where those Gen 7 classrooms uh is what Miss uh Johnson is in and where there there are uh

collaboration rooms or other rooms in the back side of them. That is not the case. These are uh regular portable classrooms and the size of the portable classrooms that all the teachers that were at Andre Dorty were in previously as well. Uh there will be water uh in uh at least two of the portables. The ones on the far left, I know there's water access to to those two portables classrooms. >> Okay. And currently the science teachers where they're at don't have water access, but now they would have water access. Uh I believe u uh Mr. Reyes was talking about uh Royal Oak. >> Oh, sorry. Not >> Thank you. Thank you. Okay. Thank you for that clarification. Okay. And then you mentioned in terms of collaboration was the principal and preschool director. So principal

of Beardsley and then principal and then preschool director who's moving from Andra Sporty. >> That is correct. >> Okay. And so um the >> superintendent is prior to >> Okay. And so Sophia, remind me of her last name. >> Valdez. Miss Valdez has been in consultation in terms of the setup and design and provided input for the preschool. And then the principal from Beardsley has provided input for the preschool and the relocation of the seventh and eighth grade buildings or just the preschool. >> The whole project because the project was a lot bigger than just the preschool part of it. >> And Dr. Just so that you're aware, the preschool classrooms, they are very specific and have to be uh licensed and that takes about six months to do as well. And that is why

finishing the project in March of 27 will be ready for the opening of school in the 2728 school year too. Um but but their whole layout is very uh specific and has to be completed and so much room every uh work area for the classroom as well. >> And that was our an evaluation of that was already done too. >> Okay. And then let's see here. I'm just looking over what people brought up. And then I mean I want to acknowledge the disappointment around the Rose Garden having experienced that myself. So I used to teach at Dery if you know the 605 freeway between uh Laura Zusa and Ramona. It's the school right there. And we had partnered with Rio's de los amigos. And we had built this beautiful outdoor garden with um like an

amphitheater. It was part of the emerald necklace. It was amazing. Um, we had our long-term English learners do a journalism program where they like actually were measuring the trees and tracking the growth of the trees based on the amount of sunlight they got and then they built construction and they tore the whole thing down and it was really sad. And so I just want to um just acknowledge that component of it. So I think that's all my questions and comments. >> All right. Thank you Dr. Hasso. I I I don't want to put in the spot um the Mercy principal, but I I I wanna I want to hear from you if they have those conversations with you. Uh can you just give us your >> Mr. Come to the microphone, please. Thank you. >>

Thank you very much, Mr. Thank you. Um um early on I had meetings with the um architect group um up here at the district and I met with um the contractors um as well. >> The at any point do you share with your staff or it was just between you and me >> with about the room the >> any other plans? I did share at one point about tenative plans and um what was shared with me on like some some tenative timelines um as far as input on classes or um the makeup of them. No, we did not have those conversations. >> Okay. >> Thank you. >> Is that it? Okay. >> Thank you. Um, I this afternoon when when uh when I walk around, I noticed that it was uh a lot of mud

at the in the back side of the uh the garden. There were two tables that I could not access there because it was a lot of water in that. That's what is the reason for that that there is a lot of watering the plants or >> I I believe it's just the watering sprinklers. It was um probably overflow from the sprinklers. >> Today when I went it was, you know, I even I even see a lot of water and I thought why so much water and I can see it was mad. So it's just >> I have one more question. Sorry. Um, >> I don't remember who brought it up, but possibly I think it was Vanessa who mentioned maybe having the opportunity to relocate it. So, I'm looking at the prints and then I'm

looking at the satellite view of Beardsley and like to the north of the amphitheater. It looks like there is a grassy space there. It's really hard to tell like what the overlay is with the new development, but I'm wondering if that might be a great space. >> I'm sorry. That is where uh the swing set um is placed. Right now the swing set is horizontal and it was developed to be moved over and be vertical there. >> So you're talking about the the swing set on the blue rubber. >> Yeah. >> Okay. >> I have I have a question. >> Yes, Mr. Reyes. >> What is uh what is the current count over there? student count. Is that a question for you, Mr. R? >> Can you come back to the mic, please? >> It's

it's the issue is the audience can't hear you from the back. That is why >> those who are at home listening watching. >> Um it's just under 500 including our prek SEC. >> Okay. >> Um >> second question, how much more is this going to increase the population there? I don't have the numbers for the state preschools. So, I wouldn't know that off. I I don't know their enrollment >> because I'm I'm concerned about that traffic around that neighborhood. That's that's going to add what another I don't know or another 100 another 150. >> Yeah. Uh I believe I I don't have the numbers in front of me right now to say it off but it's under 100 kids right now at on boarding. >> But the preschool the the preschool program has different schedule

>> they they have a a morning an afternoon and a full day. >> So they do Yes. You're right. They do come putting in the larger classrooms. How much more is that going to increase the capacity of that school? the the capacity for the TK8 school is going to be remain the same because they have the same amount of classrooms through. Um what the the project is really is building the uh preschool um hub uh for the district there. We will also still maintain our preschool classes at Maxwell. So I want to make sure that's aware as well. >> Okay. But the K8, how what's the capacity of the K8? >> The TK8 capacity for for that school was over 600. Um and that again we're not moving or eliminating any classrooms. So that number

still will remain the same. >> Thank you, Mr. Romero. >> Yes. Thank you. >> All right. Any other questions or comments from the board? Um I I I will I' I'd like to just take a moment here to I guess make a couple of comments. Um I um I think that I would have been one of those uh kids who spent a fair amount of time in the garden. Um, I think I've mentioned it a couple of times. Whenever at at Valley View, whenever the bell went off for when there was a wild animal on campus, everyone else, you know, was told to run to the rooms and I was running out to go find out what the animal was. Um, I was always very excited about that. I I enjoyed the outdoors very much.

So I I do um I do very much uh imagine that there's going to be a loss um with the the reduction uh of this garden. Um at the same time I do think it's important um to to have uh this modernization and expansion project at the same time. Um, so I mean I I think it should be a uh if if this is the the decision of the board this evening to to approve this, I do think that uh we as a board should make a concerted effort to uh work with uh our school district here as as well as the city to figure out a way to to get some green space back um at Beardsley. I I really appreciated Vanessa's comment about that. You know, if if this does have to go

through, you know, so be it. But I I do think that it's it's incumbent upon us um to to try to find a solution um to that issue. Um you know, we we we didn't say it tonight um but at our regularly scheduled board meetings, we do talk about how We have the the responsibility to make sure that every student can learn. And I do because I was one. I'm there's kids that learn better outdoors. There's kids that that need to see uh and understand a connection to what they're learning in the classroom in the in the environment. And so I do I do think that um that should be a priority of the board. that's at least that's what I'd be in favor of um if it's the the will of the board to

go ahead and move forward with this project. Um and and I do I'm I'm cognizant of the fact that you know there there are timelines for this stuff and and we want to make sure that we can um move along with projects. Um I don't I don't recall what DSA stands for. I'm sure you told me Mr. Crosby. Does anyone can someone share what that stands for? Okay, there we go. State architects. Thank you very much. Uh, so the Department of State Architects, I mean, I um I know that at the state level sometimes things move at a glacial pace and so um it's it is I think it's important to if if we're going to take action on this to to do so in a timely manner. But I I do really want to

make sure that um that particularly the the students realize that that um I have I have a a soft spot in my brain and my heart for the outdoors. Um and so I' I'd like to see if we can do something about that. Um, and I I also wanted to just verify and confirm that everything uh all these portables and and the construction that's happening um this is all single story. Is that correct? >> Yes, sir. >> Okay. All right. Thank you very much. Um All right. I think that is all the questions and comments that I had. >> Yes. that is any area where um the park begins that we can do anything that can be connect still connected to the students that we can have that area >> that in in inside where

Beersley Park is. I think we could uh would need to have a discussion with the city. Um, it is still our property, but I know we have a joint use agreement and to see if if that can be replicated. Uh, but that would be a discussion with our joint uh use agreement >> because I know that it was an area dedicated to it. I know it's kind of far from >> that that is on if you're looking at at this on the most south uh east um area of the park. Um and you know I was out there today. Kids play on the field during recess. Uh they don't go all the way over um to the far uh southeast section of the park. Um but uh we can look at our joint use agreement

and um talk with uh our school and use um make sure to see what resources we can use. Okay. Uh board, any other questions or comments before we proceed with a vote on the motion? All right. Uh, so we have a motion and a second. We've had our discussion, so we can go on to a vote. We can do a roll call vote here. So, uh, board member Diaz >> in favor. >> Board member Finlay in favor. Board member Hginin >> in favor. >> Board member Hasso. >> I'm in favor. >> Board member Reyes, >> no. >> All right, the motion carries. Four to one. Next, we'll move on to item number seven. Approve approval of the traffic signal construction agreement for Crestfield Town Homes development with the city of Deardi and Crestfield Town Homes.

Uh, do I have a motion to approve? >> Motion to approve. >> Second. >> Motion by board member Diaz, second by board member. Any discussion, board? >> Yes. Where is the signal going? >> Yes, sir. This is on uh Buenav Vista and Kell Way. Um right in front of where uh the the map on the preschool is located. Um currently right now on Buena Vista uh there is flashing lights to to distract or tell drivers that people might be walking across or not. Uh this will put a stop signal at uh that corner and um the The shared cost of this is a third with the district, a third with the city, and a third with the Crestfield developers for a cost of the district of $175,000 and um not coming out of general fund.

>> And why is Crestville Town Homes involved with the signal down there by Beardsley? Uh that was just one of the agreements that uh when they came aboard, the city put that on them to wanting to um put an extra light there for the safety of Beersley School. >> Interesting. >> And uh Mr. Crosby, sorry, Mr. Reyes, were you done? >> Yes. Okay. Uh Mr. Crosby, the you said that this is not coming out of general fund dollars. So where does this come from? I believe it's coming out of uh developer fees as uh >> Miss Bale says waves. Yes. Has Yes. Uh developer fees. >> I see. Thank you very much. >> Um and is it is it going where the current crosswalk is or is it going to be on the northern part
