001Okay, thank you Bonnie. We will reconvene into regular open session. It is 6 pm. Let us go to item six. Report any action on items from close session. There's nothing to report out. So, let us now go to item seven, communication reports. Reports one or 7.1 through 7.4 are limited to five minutes. We will start with uh we'll start with the board members reports 7.1. Trusty Keer, I have no report. Okay. Trustee Turbull, no report. Okay. Trustee Mansfield, no report today. Okay. And then Trusty Banister. Okay. I just wanna um uh let me think. Last week as city council, I just wanted to support uh Principal Zunino with the police advisory committee. I'm really proud of our school district for continuing to work with the police department in that partnership. Um I'm also um went
002to the South Tahoe chamber meeting. Um and I'm I just love it when different committees and boards come together in support of what the district is doing and just helping our community all around. Um, I also, my brand new 13-year-old daughter is in the enrichment camp for volleyball. And today I got a chance when I dropped her off um, you know, just really to be um, impressed with the leadership that was outside welcoming the kids, guiding the kids. I love that Vice Principal Inon was um jumped in and played volleyball with the kids. And I mean when I asked my daughter about her experience, she was like, "Oh, the best part was, you know, um the principal that stepped in and then I learned he was the vice principal and he played with us. Mom,
003he's an adult and he played with us and I was like, "Sweet." like and it was just nice to hear that it's like that little comfort of, you know, normal normal summertime. So, um that's pretty much all that I have. I just really um you know, I'm really proud of our district. I'm proud of the people working hard to make things better even while we're just still kind of, you know, figuring it out sometimes. Um so, that's what I got. Okay, I will I was going to read this thinking that we're going to have a bunch of people here, but I'm going to put it into the record and then I may have to come back to it. Okay, I understand that many folks in the audience are here for the agenda item 11.4. We
004have other business to attend to. We'll move as quickly through that business as possible. If you would like to step out during the agenda items that are not related to mass, we will pause just prior to make sure you are in the room prior to the agenda item 11.4. This is a meeting of the board in public. I need to ask all attendees to keep an environment that is civil and respectful. We are requiring masks for all our board meetings. So, I ask that everyone please wear their masks the entire meeting. Okay. I just want that in the record. I may have to come back and read it again. Uh, we'll see where that goes. Yay. Yay. Yay. Okay, let us go to item 7.2, superintendent report. Dr. Culler, Mr. President, members of the board,
005I want to let you know I was informed this morning by STEA President Jodberry that STA voted yes to ratify our negotiated agreement that we worked on this summer. Jod informed me that she was not able to be in attendance this evening, but she wanted to make sure to thank her negotiations team and the district for their efforts um on the successful negotiations. The highlight of the agreement are around teacher evaluations and Wednesday collaboration. Specifically to Wednesday collaboration time, each school in the district will get out approximately one hour early each Wednesday for staff professional development and collaboration. Principles will be working on updating their Wednesday schedules and communicating these changes to parents soon. Next, I want to just talk in the past two weeks, we've re relaunched our meetings for of our health and
006wellness committee. I want to thank the Barton team for their continued teamwork and collaboration. With this with that said, I'd like to ask that Dr. Snaringer provide the board an update regarding the current COVID data. Um, I believe she is uh online on the Zoom for us. Dr. you have her. Okay. Well, she said she would be on, so would you just do Okay. Well, um, if can I add something? Yeah. Okay. If we don't get Dr. Seringer to talk to us, she did write a letter to the community. Okay. And I have a copy of it. I don't want to send it to anybody, but um but it's out there and you should read it because it is powerful. So maybe we can make sure that it's sent out and can send it out
007to post it on our newsletter. Okay. And then make sure the board gets it. Okay. Okay. You know what? Um I'm assuming Dr. something to have with Dr. Schneering because she was very committed to be here with us tonight and and I really do appreciate her her commitment to uh this work on our committee. The letter is very powerful. All right. Thank you. That's that is all from our report this evening. Okay. Let us let us move to 7.3. Okay. And that will be employee associations. Do we have anyone from the associations? Yeah, I don't believe we have any reports this evening from associations. Okay. Okay. Okay. Let's go to 7.4. Doc. Um, do we have any public comment? Do we have any public comments this evening at this time? off agenda public comment. I
008don't I don't need to read this. Okay. Okay. Let's turn, please. Okay. Let's go to educational services. Uh associate superintendent Anamarie Cohen. 8.1 activities and preparations for the start of the 202122 school year. To the board. This isformational. Go ahead. Uh good evening, President Riley and Board of Trustees. Um as stated, this is an information item. We are very excited to be planning for the upcoming 2122 school year. The start of this year with full in-person learning opportunities is setting the stage for a fantastic school year following a year of educational challenges. Tonight, Dr. Alan Reer will present the activities put in place to launch our successful next school year. Dr. Reer, President Riley, and trustees. Um, LTUSD staff have been very busy preparing for an exciting and productive school year for our students. A
009variety of activities have or will be taking place in the coming weeks to support our wonderful team. Let's see. Do I have a [Music] As you're aware, we've hired some new positions. New coordinators include Miss Megan Steves and Miss Karen Goldberg. and new directors include uh Mr. Simmons and myself, both Dr. Cohen and Dr. Cutler have been busy orienting and training all of us. Also, in early July, we had successful collaborate collaborative conversations with the SDA team as as we discussed last time. One component of our successful negotiations that Dr. Cutler mentioned includes that one hour early out on Wednesdays for collaboration and professional development opportunities. We'll be working with our principles and other leaders to develop a schedule, communicate that information to our families, and revise our school calendar. Additionally, district staff have been
010reviewing and interpreting assembly bills in regarding new changes impacting us for this upcoming school year. For example, Mr. Simmons will be reviewing information about AB 104 tonight and we will be sharing information on AB130 on August 24th which is highlighted in your board policy this evening in your board policy updates. Okay. Right. We are also excited about the summer opportunities for our students. Uh for the past three weeks, five of our wonderful teachers have been working at the Boys and Girls Club to provide reading support interventions for some students along with music and art enrichment for all of our students. This week, as Brandy mentioned, um started our enrichment camps. We have 16 of our teachers supporting those efforts. Uh we have approximately 200 students that are participating in a variety of activities. You mentioned
011volleyball. We also have art, physical education, STEM, music, percussion, hiking, and even mountain biking. Our principles are also supporting these efforts all week. Next week, jumpst start opportunities. We'll be supporting incoming first through fifth grade students at the elementary schools along with our incoming sixth graders at South Tahoe Middle School and incoming 9th graders at South Tahoe High School to help prepare them for success for their upcoming school year. Please note, it's not too late to sign up and you may contact your child's school if interested. [Music] Over their music, huh? All right. We're planning learning opportunities for our leaders as well. District and site leaders will be participating in training on a program called Elevation on tomorrow and then again on August 19th. Elevation supports students who are English learners. Leadership Council will be
012meeting on August 12th to receive training from Dr. Cutler on school culture, relationships, and instruction, as well as additional training from directors on goals, classroom observations, evaluations, as well as an activity related to the summer book read what great principles do differently by Todd Whitaker. Then on August 13th, our leadership council and content area specialists will be receiving training on learners learning focused relations from outside presenter and retired Wo County School District administrator, Miss Fa Patty Fowler. We also have teacher learning opportunities uh set up come coming up for this this August. First, we're going to be providing training for all of our new employees on August 24th. They will receive information from our HR and payroll departments, and teachers will be able to receive training on our Canvas system. Second, NWA MAP training with
013an emphasis on effectively utilizing student data to impact instruction will be provided for several teachers and administrators next week on August 17th through the 18th. These teacher leaders and administrators will then facilitate a training for all teachers on August 25th. On August 25th, all teachers will be receiving a variety of training opportunities. In the morning, teachers will hear from professional consultant Nicole Anderson regarding closing equity gaps. Following, teachers will be receiving the training on utilizing that MAP data to impact student learning with an emphasis on closing achievement gaps. After lunch, teachers will receive training from Dr. Cutler on implementing a successful collaborative learning community. Finally, teachers will finish the day with their school leaders and school teams to recap the day's learning and apply their new knowledge in their own schools. We also have some
014final activities planned as we prepare for our students returning on August 30th. Our leadership team will be meeting for a training and breakfast kickoff on August 19th. Our district office team will be meeting for a quick training on August 20th. Dr. Cutler will be meeting with all staff on Thursday, August 26 for a brief welcome back and kickoff message around culture and vision for our 2021 2022 school year. District leaders will be touching base with with site leaders on August 27th to provide last minute updates and support. Finally, we're excited to welcome back all of our students on August 30th and are feeling confident and ready for our students to return for a productive 2021 2022 school year. In summary, as you see that we've been very busy planning and preparing and receiving a variety
015of training to prepare us for our upcoming school year. Our training aligns with our LCAP goals and our needs. We're excited to get started on this school year with our students. This information is presented as information only. Do you have any questions? Any question? Any questions or clarification? I do have a question. Um, is there going to be training like on Canvas for any substitute teachers? On Canvas for substitute teachers? Yeah. You don't. We could invite them on August 24th. That's a great suggestion. We can work on that. Thank you. That's quite a lineup. I look forward to attending some of the events. Oh, great. We hope to see you. Anyone else? Mr. President, I would make have a request because um we were having technical difficulties with Dr. Snaringer when we were at at
016that place on the agenda which was under my report. I would ask the board to allow us to move back um so that we could hear from Dr. Schneer. He is on the line. Okay, that'd be great. So, um, so just reverting back to that one point of it under my report, I'd ask that Dr. Sner provide the board an update regarding the current COVID data. So, Dr. Sner, are you there? I sure am. And I uh apologize for not being present uh few minutes ago. I was in the wrong waiting room apparently, but I'm here now. You'd think after a year and a half I'd have this down. um uh board members and parents and teachers, I just want to acknowledge both the excitement and some of the anxiety that may be going on
017um with the thought of return to school. I know that some of you are anxious about children masking. I know that some of you are anxious about your children contracting CO 19, but I'm here just to share some facts about what's happening in our community. And I'd also like to share with you as a mom and a pediatrician just how uh excited I am that all four of my children for the first time will be in the district and starting um class in just a couple of weeks. So I'm very optimistic and very happy to be starting the school in person. So here's a here's some of the facts which you know are headlines everywhere but yes corona virus cases have been increasing across the country and in our community as well. Elorado County's percent
018positivity rate as of today is 10.9% and that is still trending up. It's been gradually increasing for about three weeks. For comparison, at the peak of last winter, our percent positivity rate was 15%. So, we are not as high as we were last winter. What this means is that out of every 100 COVID tests sent, about 11 are positive. The good news about this is that the northeastern United States and the western United States seem to be fairing fairly well compared to the south. Um, and already in the Northeast, cases seem to be leveling off. So, what does this mean for us? I am hopeful that it means that this surge will be relatively short-lived. And if we look to other countries that experienced Delta, um in particular Israel and England, they did have mitigation
019factors in place, but Delta did uh decline quickly. And so I'm hopeful that this will not be months and months ongoing, but we will see. The Delta virus, as you've probably heard, is two to six times more contagious than the virus that circulated last year. And it gives you a thousand times more virus in your nose, which makes it harder for your immune system to fight it off. And for the unvaccinated, the risk of hospitalization is about twice what it was with the virus we were fighting last year. And that is adult data, not pediatric data. We don't have the pediatric data yet. The good news with all of that is that the vaccine is still highly effective. We are seeing breakthrough infections, but they are low in number and mild in severity when compared
020to the unvaccinated population. Vaccinated people are only very rarely getting hospitalized compared to those that are unvaccinated. So I think all of this um despite what is happening right now um I think we can be very optimistic that with a community effort that the impact from corona virus will be much less to our students this year but these are my recommendations for what all members of our community and members of the district need to do. Um, we do have masking which is proven to slow the spread of transmission by catching droplets inside the mask before it is spread into the air. And there's no validated scientific research of adverse health consequences. And masks are currently being required both by the state of California and Nevada in schools and in public. Our best protection against spread
021for children who cannot get the vaccine yet is masking. We understand this year much more about how the virus is spread. And I think that by remaining responsible and diligent about quarantine and isolation, by keeping our kids home, even with mild illness and getting them a COVID test, even though it's inconvenient, we can minimize school closures. We know that despite increased numbers of children hospitalized in the south that childhood illness does remain mild with less than 5% of children's having any symptoms beyond four weeks. And finally and most importantly, our community has a highly effective and safe vaccine. Vaccination pro uh protects our teachers. It protects the vulnerable at home. The vaccination of teenagers and adults will also help protect those that cannot be vaccinated due to their young age or for those members of
022our community where the vaccination is less effective due to their immune systems. And vaccination across the US and across the world can help prevent future varants. The more people are infected, the more the virus mutates. Vaccination stops these infections. And so hopefully as our world gets vaccinated, we will see fewer varants. We know what a school year looks like and no one would argue that keeping schools open is absolutely the right thing for our community and our children this year, but we need everyone's help. Um follow masking mandates. Get your kids vaccinated if they can. Get yourself vaccinated if you can. Stay home um if you're sick and let's get moving with Let's listen. Please say that again. No, I'm all done. Okay. Thanks. Thank you, Dr. Sner. Before you do, Mr. President, members of
023the board, I want to um if you don't mind, and I know we moved on to 8.1 um and as we've received uh the different agenda items, I mean, excuse me, the different public input, most were are for 11.4 for this evening, but we did see did in the end pull two that are under public input normal. Now, you've already passed by it, so it's up to the board if you'd like to return. There's two that have requested to speak under public comment. So, Mr. President, if the board is so do has the pleasure to do so, go back to 7.4. That's up to you as a board. No, I I want to go we'll go back to 7.4. We'll let the two people speak. However, before Yeah. However, before we do that, I read
024this into the record um before you came in for the people came in the room. I understand that many folks in the audience are here for agenda item 11.4. We have other business to attend to. We'll move as quickly through the business as possible. If you would like to step out during the agenda items that are not related to mass, we will pause just prior to make sure that you are in the room prior to agenda item 11.4. I want to remind everybody this is a meeting of the board in public. I need to ask all attendees to keep an environment that is civil and respectful. We are requiring masks for all board meetings. So, I ask that everyone please wear their masks the entire meeting. Okay. Okay, go ahead and introduce. Okay, Mr. President,
025but do you want to read into the record um the public comment or you are you ready to move forward to public comment? Let's move forward. All right. Thank you, Mr. President. So, we first have um Sherry Eddie regarding critical race theory. Yeah. Yeah. This it's not agenda. Yes. Going to be short and sweet. So, I thank you for letting us be here and for letting us address these situations, these issues. And I would like to address the CRT, critical race theory curriculum. This curriculum has no business in our school. It creates division and hatred. We need schools to focus on English, math, science, and skills that will help the children in succeeding as an adult such as budgeting, bill paying and such. CTR or CRT creates confusion and division in young minds of these
026children. CRT is a movement teaching white shame and that if black people are doing well, they're acting like white people. Let them be kids and leave movements, politics, and propaganda out of the classroom. Keep it out of the classroom. There should be other ways we as parents, teachers, and a community can work together to teach our children good character and compassion for all. Thank you. And that school should be teaching math, science, and those curriculums that are needed. Thank you. All right. And the next one that's not on the agenda is Brandy Griffith. Affidav. Thanks, Brandy Griffith. Um, I want to surrender my three minutes so that we can serve our affidavas. So, anybody that has one, please bring them forward. This is Okay. Thank you. [Music] know that you've been put on notice. This
027is a notice giving you an opportunity to respond within seven days for the attempt to squaltch our constitutional rights. And within the seven days, if we don't hear back from you, we'll take it to the next level. Thank you. Okay. So, Mr. President, that is all of the um public comments that we've received that are not related to um to an agenda item. Now, we had already concluded 8.1. Um I believe all the board members had an opportunity to have a questions answered on 8.1. So, we'll if you're ready, we can move to 8.2. Okay. We'll move to 8.2. The assembly bill 104 grade change retention exemption requests. Once again, this isformational. Dr. Cohen, President Riley and Board of Trustees, this is an information item. Existing law requires governing board of a school district and
028county superintendent superintendent of schools to adopt policies regarding pupil promotion and retention and requires a pupil to be promoted or retained only as provided for in those policies. for the 2122 academic year. This bill would require a school district, county office of education, or charter school to implement a supplemental policy regarding the retention of pupils who in the 2021 academic year received deficient grades. Tonight, Mr. John Simmons will present the specifics of AB 104. Mr. Simmons. Good evening, President Riley, board of trustees and community. Tonight, I'm presenting information on Assembly Bill 104. All right. On July 1st, Assembly Bill 104 went into effect. This bill has three key actions that districts must address related to retention, grades, and graduation requirements. Key components of the retention changes. Students must be eligible if you are a student
029in kindergarten through grade 11 during the 202021 school year and at least half of their grades were deficient which includes D, F and no pass marks and you are in eligible. Students must offer con students or sorry schools must offer a consultation meeting upon a written request of retention. The consultation meeting includes the parent, the student, administrator, and teacher and occurs within 30 days of the request. During the meeting, learning recovery options, academic data, and any information relevant to whether retention is the best interest of the student to be considered. The school makes a decision concerning retention and and must notify parents within 10 days of the consultation meeting. Regardless of the decision to retain, academic support must be offered. Grade changes to pass or no pass. Uh districts must post information which includes a
030list of colleges that accept pass no pass marks, a statement of caution that not all colleges do accept pass no pass marks, and application form grade changes within 15 days of the Department of Education posting the application for grade change form. The California Department Education posted this document during the week August 26th. Once Parents of high school students from the 202021 school year have 15 days to submit an application to change any grade of their students. The deadline for Lake Tahoe Unified parents to request grade change is this Friday, August 13th. Once a request has been made, students grade must be changed within 15 days and then parents notified. Key components of graduation requirements. This only applies to eligible students. These are students in grades 11 and 12 during the 202021 school year who are
031not on track for graduation. These eligible students may be considered for graduation based on the state minimum graduation requirements. These students may also request a fifth year of school in order to meet these graduation requirements. So review of Assembly Bill 104 requires districts to make changes to the retention requirements. It allows students in high school to change their letter grades to pass no pass. And if eligible, students can graduate based on state minimum requirements or completion of a fifth year of high school. Thank you. Any questions? Any questions or comments or clarity? Let's move to 8.3. Equid metrics survey data. Dr. Cohen. [Music] Okay. President Riley and board of trustees, tonight I will present the results of the equric survey. This was a staff survey allowing us to have a view into LTUSD's organizational culture,
032diversity, and inclusion practices. Tonight, I will share broad information about the econometric survey, why we proceeded to give the survey, the results, and implications for future practice. Equatrics is a survey that allows LTUSD to gain critical data that will help guide improvement efforts related to our educational systems with a particular focus on diversity, equity, and inclusion. The survey allowed us to establish a baseline in the perception of how LTUSD functions as an organization in relation to these three areas. Diversity, equity, and inclusion were identified as areas that needed to be addressed in the LCAP process during the 2021 school year. Ongoing implementation of the survey on a yearly basis will allow us to obtain measurable data to determine if we are making systems improvements year-over-year. The key reasons for LTUSD to address systems improvements with
033a particular focus on equity and diversity are the outcomes that lead to increased student engagement, improved innovation and positive organizational performance, increased leadership and diversity and equity training and systems shifts to improve our school district alignment of our LCAP priorities, goals, and actions with an equity lens. And finally, to interrupt inequitable practices, challenge biases that exist, and create inclusive school practices. This is one tool in combination with student data such as MAP, CASP, and student and family survey data that will determine if we are improving diverse student group performance, increased access and opportunities, and achievement for all of our students. The equric survey measures the perception of the presence of diversity, equity, inclusion, cultural competency. Our mission, vision and values, leadership, alignment of policy and policy and practice. The survey structure included the nine scales
034just identified and had staff rate the presence of overt discussion and focus on diversity, equity, and inclusion on a scale of 0 to 10. The survey was sent to every staff member in the district, a total of 433 surveys. We received 350 responses for a response rate of 80.8%. The survey was distributed in April of 2020 and was open for three weeks. Key observations of the survey indicated that across all nine of the scales, we had responses of a total of 42.5% of responders felt that there exists a lens of ex equity throughout the nine scales measured. This allows for us to begin to ask focus questions and design strategic actions to begin to move our baseline so that we can improve. Each scale was measured and rated based on questions that were asked. As
035you can see, the communication scale was the lowest in the strongly agree agree scale, indicating an organizational weakness. The items that staff were asked to rate were the following. In my organization, we regularly receive information on our diversity, equity, inclusion, and cultural competency practices. And in my work group, we regularly discuss our plans for diversity, equity, inclusion, and cultural competency. It was clear through this survey that there were there are intentional communication actions and activities that need to occur in order for us as an organization to improve our work embedding a diversity and equity framework in our collaboration, instruction, and systems practices. Data showed that there were relative relationships between inclusion and diversity. inclusion ranked higher than diversity. Meaning that if we support increased diversity, the efforts will be built will be built on a
036stronger foundation than if inclusion was low. Additionally, there was alignment in our mission, vision, and policy solidifying that if we broadly communicate priorities, we will have a large impact on all of the scale areas. Um, this slide shows the demographics of the respondents by location of work across the district. This slide disagregated the demographic data by elementary, middle, and high school staff and then other locations within the district. This data identified the number of respondents by the number of years in the district. Disagregating the data in the above formats allows for us to analyze the perceptions of employees by the number of years and location of employment to determine if there are trends in our systems approaches to diversity, equity, and inclusion. Looking at who responded to the survey in what manner allows for us
037to set the stage to actions and activities specific to needs of different employee groups in different locations across the district. All with the intent to better focus on student engage engagement, achievement, and overall outcomes. The equric survey allows for us to focus on our strengths, weaknesses, and capitalize on opportunities to develop a plan to identify goals specifically around communication. [Music] As a result of the information gathered through the survey, LTUSD needs to intentionally plan for increased training on how to engage in equity conversations that lead to a new level of discourse. examine the racial inequities and implicit bias that has been identified in order to support reflection and future action. Increase cultural responsiveness to diagnose challenges and support students to grow and learn in an effort to reach cultural proficiency. And finally, to learn strategies
038for productively addressing implicit bias and systemic inequalities. Are there any questions or comments from the board? Comments. I could um Dr. Cohen, thank you for the presentation and um I really appreciate the work and the survey was done this April. Yes. Okay. Because I think you said the 2020, but I was I wanted to make sure it was this this April and then we would do the survey. We would do the survey again next April. Um we are going to bump it back um a little bit into more like February. We want to have some time to get um begin the work um to see if there are some some changes. What's really important about that question, we want to make sure we're collecting data um at a time where it impact the decisions of
039our local control accountability plan. Okay. Thank you. And so when we think about you having the econometric survey, when we think about parent surveys, staff surveys that are different or metric survey, um that all help drive any decisions that may change the actions of our district. And then because we're bringing that forward like February then that it sounds like the professional development a lot of the training that we're planning for the fall. I mean that puts more pressure on kind of getting information into teachers hands sooner. So that you know I mean that that's the way I look at it. Right? In some ways it's a good thing because we're saying hey we're going to evaluate this again in February. So we really want to get started like we want to start at the beginning
040of the year. We don't want to wait on getting information to teachers and families and really, you know, so that everybody can be working to improve. Well, I I think that that that that thinking is right on, but one one thing I would share is it's year in and year out looking at the data and looking at growth from the from our organizational assessments, ecomtrics assessments to student performance. So, this year was a little later our LCAP discussions um um occurred and then as a result of those discussions, the need was derived, but that was a little later. will start those discussions earlier in this school year and the work earlier in the school year. Good. Thank you. U first I want to compliment you on uh getting such a high response rate. That was
041impressive. Um, secondarily, it's it's um I'm um it was great to see that there's a cohesive sense that's not only supported by the data of the raw data from test scores and so on, but there's also that consistency with the perception and so it looks like we have a unified view going forward. Thank you. Let's move to item nine, business services and operations. Associate Superintendent Andrea Salazar. Let us go to 9.1 schoolworks professional services. This once again isformational. Good evening, President Riley and members of the board. School works, established in 2002 by Ken Reynolds, is considered a leader in the fields of facility planning, demographic analysis, and state building program eligibility. They work exclusively with California school districts ranging in size from 200 students to over 500,000. LTUSD has engaged with school works to provide
042first and foremost a demographics and enrollment projection, trustee boundary analysis, and a developer fee justification study proposal. On behalf of Mr. Reynolds, I will be presenting a short synopsis of the background of schoolworks and that that they are proing proposing for LTUSD. Much of that presented on this slide has been addressed. However, in particular, I would like to note specifically that school works possesses over 30 years of experience in the school facility business and has assisted schools with over four billion in state funded projects. The services available are state building program, developer fee studies, demographics, facility master plans, facilities planning assessments, and school locator. Schoolworks has worked with over 230 school districts in California. That that they are proposing for LTUSD contains the following items. First, a demographic study which includes enrollment projections based on
043historic trends as well as current birth data and plan new development. This study will also assess the enrollment and population by area allowing for identification of options for strategic district reallocation. This information is compared to capacity to determine school facility utilization. Next is state school facility funding which assesses the district's eligibility and maximizes the use of resources from the state building program. This includes new construction and modernization in addition to the new opportunities upcoming for expansion of TK to all four-year-olds. Developer fee study is that which justifies the collection of fees and identifies plan district use of the fees. These are a common source of funding to pay for school facility needs. The allowable fees are established every two years by the state allocation board and are anticipated to increase 4% in January. The last
044study conducted for LTUSD was in 2013. Lastly is a trusty boundary analysis, which is an analysis of trusty areas. School districts are required to analyze the population in each area using the 2020 census data. Changes are only made when there is peak variance of greater than 10%. The deadline to make changes is March 1st, 2022. It is the district's intent to bring these proposals to the August 24th board meeting for further discussion with final approval being requested at the September 7th board meeting. This is an information item. Are there any questions? Quick question. Andrea, thank you for the presentation and I thought the agenda item was well there's a lot of good information in there. Um and it seems like a fairly short um contract term. When when do you expect to have the results?
045I know you said the requirement we have to make a decision by March, but when do you expect to see the the information completed the cont? Probably not till I would say Octoberish. Yeah, I would I I I believe that we said to Mr. Reynolds that we really want to make sure the information was available but by November as we correspond with the work that we're doing with our facility masters plan. I'm hoping we also have the opportunity to collect information on how our families are moving amongst the schools. I think that that would help us with facility planning with as well as transit planning and um just give us a sense of what's happening. That is something that we would like him to look at as well. Most definitely. Anything else? Okay. Thank you.
046Let us move to 9.2 two, contract with affordable construction services. This is an action item to the board. President Riley and members of the board as discussed in July 20th, 2021 board meeting, the floor at the Al Tahoe kitchen, hallway, storage room, and bathroom has been damaged by a water leak and identified to be health hazard by El Dorado County and Environmental Management House Specialist during her semianual inspection. It is staff's recommendation that the board of education approve the contract with affordable construction before replacement at the Al Tahoe site. Are there any questions? Questions or questions or comments? Okay. Go ahead. I move that we uh approve the contract with the affordable construction services. Okay. Dr. Cutler, do we have any public comment on this? No, Mr. President. Okay. Okay. Okay, since we have any
047other comment or question from the board, so I can move on. Okay, since we do not, we um we have a motion, we have a second. All those in favor say I. I. I. All those opposed. Okay, motion passes. Let's move to 9.3 contract with Studio W for Lake Tower Unified School District Facility Master Plan. Once again, this is an action item. President Riley, members of the board, as discussed in the May 11th, 2021 and approved in the May 25th, 2021 board meeting, the district released a request for qualifications for a facilities master plan to identify the numerous facility and site needs of Lake Tahoe Unified School District. ALTUSD received seven responses. A panel was assembled to review qualifications to include presentation, content, and price. After analysis, the panel selected Studio W Architects. The vendor
048provided an introduction of the organization and overview of the facilities master plan process in the July 20, 2021 meeting. It is staff's recommendation to approve the contract with Studio W Architects for the completion of the facilities master plan. Are there any questions? Okay, let us move. Do we have a motion? I move approval of the contract with affordable I mean a contract with Studio W. Okay. Okay. For Lake Unified District Facility Baster Plan. Okay. Second. Okay. Dr. Cutler, do we have any public input? No, Mr. President. Okay. We have a motion. We have a second. All those in favor say I. I. I. All those opposed. Okay. Motion passes. Let us move. Let us move to uh item 10, personnel services. Once again, Andrea Salazar. And this is 10.1 new and o and and or
049revised job descriptions. Once again, this is an action item. President Riley, members of the board, as presented in the June 22nd, 2020 and July 20th, 2021 board meetings, the district has developed and/or revised a number of job descriptions to include dean of students, director of innovation and technology, educational specialists, and technology database specialists to be placed in effective for FY202122. A highle summary of the basic responsibilities of each position has been provided. It is staff's recommendation that the board of education approve the dean of students, director of innovation and technology, educational specialists, and technology database specialist positions as presented. Are there any questions? Okay, we need a motion. I move approval of the new and revised job descriptions. I'll second that. Okay, any other Dr. Cutler, do do we have any uh public comment? No,
050Mr. President. Okay. Any other board comments or questions? Okay. Then let us we have a motion and we have a second. All those in favor say I. All those opposed. Okay. Motion carries. Okay. Let us move now to item 11, board governance. Superintendent Todd Cutler. We'll start with 11.1. Revised Board of Education regular meeting schedule. Once again, this is an action item. Mr. President, members of the board, this item came to you as an information item on June 22nd. Returned as a discussion item on July 20th. The district has heard no comments or concerns regarding the change from the the second and fourth Tuesday of every month for our board meetings to the second and fourth Thursday of every month. The recommendation is that take this for to take effect starting October 1st of 2021.
051And so to staff's recommendations, the board of trustees approve the change in board dates from from the second and fourth Tuesday to the second fourth Thursday starting October 1st. Okay. Okay. I move adoption. Oh, is it too thick for them? No, no, you can do you can do it. Do we have a motion? I move adoption of the new meeting schedule. Okay. Second. Okay. We have a Do we have any public comment? Dr. Cutler? No, Mr. President. Okay. So, then let's move to We have a motion. We have a second. All those in favor say I. I. I. Opposed. Okay. Motion passes. Let us move now to 11.2. First reading of the board policies administrative regulations June and July of 2021 updates. This is anformational item. Mr. President, members of the board, you have several
052board policies and administrative guidelines in your packet for your review and information this evening. Um, if there are questions, we can be they can be addressed. One highlight is that uh AB130 requires some adjustments to board policy specific to independent learning. Um and and you will be receiving a presentation on that um specifically to AB130 at our in our board meeting, but it was will be the staff's intent to bring back these items for your action at your August 24th meeting. This is an information item only. Thank you. Anybody any questions or clarifications for Dr. Culler? Okay, let us move then to 11.3. Review the 2021 board governance calendar. Dr. Cutler. And Mr. President, members of the board is staff's intent to always bring forward to you in a regular process for you to review
053the board governance calendar if in case you would like to make any adjustments or modifications to it. So, this is a for discussion if you'd like to to provide any direction. No, we'll move on then. Okay. Yep. Okay. Let us move then to Wait a minute. Before I do this. Yes. Do we have anybody outside that needs to come in? Mr. Simmons, will you make sure if anybody wants to come? Yeah, let's just wait a minute. I don't want to start and then because we did promise that we would take a pause. Yeah. Okay. All right. Thank you, Mr. Simmons. Thank you, Mr. Simmons. Okay. Let us move to 11.4. This is California Department of Public Health face coverings, masking requirements, and expectations in the 2122 school year. This isformational and discussion. Dr. Cutler. Yeah,
054Mr. President, members of the board, schoolmandated guidance regarding CO has been provided from the California Department of Public Health. In these requirements, CDPH has required masks for all staff and students in school settings. This action has created a great deal of conversation and concern by many parents. I've had a few meetings with parents that have shared their dislike for the mask mandate and the expectation that we as a district should not enforce this requirement. At our last board meeting, we had several public comments regarding this topic. At the end of the meeting, a board member requested a future agenda item for a resolution to support the science and the enforcement of the mask requirements. Following the last board meeting, we received a board agenda request from the public. That agenda request was is titled a
055resolution supporting the delegation of authority for school COVID 19 safety protocols enforcement to local school boards. Over the past two weeks, we've received guidance from district's legal team as well as our insurance carrier, both of which express our responsibility to follow the expectations of CDPH. Specifically, the district legal council's opinion was that the district is legally mandated to follow and enforce CDPH guideline in its role in the prevention of the communicable disease. Education code section 49403A states governing the governing board of any school district shall cooperate with the local health officers and measures necessary for the pretent, prevention, and control of communicable diseases in school age children. Legal counsel council highlighted certain risks for the non- enforcement of mask requirements which include liability in the case of a COVID exposure, possible loss of state and
056federal COVID relief funding and the challenge by parents or groups who support mask requirements for safety reasons. That was just a few highlights of the um legal council. Additionally, the district received a warning and directive on this matter from its general liability insurance carrier, school insurance group, which stated, "If a federal, state, local regulation, order, law, statute mandate is intentionally not followed, coverage for for any resulting claims may not be available due to the common exclusion in coveraged documents." The exclusion wording is very clear. Intentional disregard of laws will negate coverage. As such, any liabilities could any liabilities would become the sole responsibility of the district. CDPH guidance is clear as to the requirement for masks to be worn in indoor school settings. Intentional disregard of this of this requirement would most likely trigger the
057exclusion. It is important to note that I have received correspondents from parents that have articulated that they just want our students in school and are willing to wear masks to have our students in school. I've had parents communicate with me that they expect us to enforce masks for the health and safety of our schools and community. I did receive a message from a parent that implored me to begin the year virtually due to recent increases in CO. That all being said, the decision was made to bring this agenda item forward to provide the board staff's intent to follow and enforce the CDPH public health and safe and safety face covering requirements. At this time, I'd like to ask Dr. Cohen to provide an overview of the CDPH guidelines as well as the draft ideas regarding
058our district's protocols. Uh, President Rally, board of trustees, members of the community, the importance of in-person learning for all of our students became clear throughout last year as a result of the need to prioritize in-person learning opportunities, CDPH, and CDC with public health guidance for K12 educational institutions that prioritize the health and safety of all students and staff regardless of personal or political beliefs. The following guidance has been put forth by CDPH and will be followed by LTUSD for all summer and 2122 in-person learning. This guidance was released on August 2nd and updated August 9th. A short summary as follows. Physical distancing. Uh recent evidence indicates that in-person in instruction can occur safely without minimum physical distancing requirements when other mitigation strategies example masks are implemented. Quarantine recommendations for vaccinated close contacts for those who
059are vaccinated. LTUSD will follow the CDPH fully vaccinated people guidance regarding quarantine isolation recommendations for both vaccinated and unvaccinated persons. LTUSD will follow the CDPH isolation guidance for those diagnosed with CO 19. Hand hygiene recommendations. Teach and reinforce handwashing, avoiding contact with one's eyes, nose, and mouth, and covering coughs and sneezes among students and staff. We'll promote handwashing throughout the day, especially before and after eating, after using the toilet, and after handling garbage or removing gloves. Cleaning recommendations. In general, cleaning once a day is usually enough to sufficiently remove potential virus that may be on surfaces. Disinfecting removes any remaining germs on surfaces which further reduces any risk of spreading infection. Masks. Masks are optional outdoors for all in K12 school settings. All adults and students will be required to wear face coverings indoors regardless
060of vaccination status. Persons exempted from wearing a face covering due to a medical condition must wear a nonrestrictive alternative such as a face shield with a drape on the bottom edge as long as their condition permits it. Per CDPH guidelines, a medical practitioner must issue a mask exemption. Parental attestation is not sufficient and will not be accepted. Additionally, LTUSD has drafted scaffolded intervention for students who do not comply with masking requirements for in-person learning in the school environment. First, a warning, a verbal request. If a student refuses to wear a mask, school staff may issue a verbal reminder that masks are required and offer the student a mask provided by the school. Staff will endeavor to issue such a reminder privately and in a manner that does not disrupt instruction or cause undue embarrassment. Warning
061two, an informal conference. If any student remains unwilling to wear a mask, a district representative will conference with them and their family to provide education surrounding our health and safety expectations so the student can meet those expectations and safely participate in in person at school with their peers. Warning three, written warning and notification of other options for the student to access their education in a safe manner in line with CDPH requirements and offer the student the opportunity to come into compliance. Following this, virtual school enrollment and independent study is the option. A student who continues to be unwilling to wear a mask following three warnings will be immediately enrolled in LTUSD's alternative off-campus instructional program, Elevated Virtual Academy in grades TK through 9th and Independent Study through Egeneuity in grades 10 through 12. Students who
062are enrolled in elevated or independent study may return to the classroom when compliance with LTUSD mask policy is followed. Students will return to a school grade level and course sit course schedule which has enrollment space. Students who do not comply with mass requirements at each of the levels of warning will be supervised outdoors until the end of the school day. Please note this is a draft policy and subject to change as guidance changes. Are there any questions from the board? Any questions? I have a question. Has there has there been a conversation about ways we can help uh especially early educator, you know, early elementary educators um really improve their ability to communicate with students? I'm thinking, you know, it's um there's just be able not being able to read lips and talk and doing
063phonics and all these sorts of things that they're doing. Are there other strategies that we're coming up with that would assist that kind of education? So we have been in conversation um with provision of their masks, face shields during certain times of instruction during the day when that um instruction is going on in the classroom. So those are conversations that are occurring right now. Additionally, we're having meetings as a health um department with our nurses um looking at strategies to support uh instruction in the classroom. I' I've even wondered if microphones might be an assistance or you know if there are others but anyway I'm I'm um I'll be pleased to hear about what kinds of things you're working on as you go forward. Thank you Dr. Cohen, Mr. President, members of the board. That
064is the presentation from staff this evening. Um we as a staff are hoping to to provide for you to provide us any direction or feedback at this point in time. Okay, this is a discussionformational item. Do I have any board members who want to make any comments? Sure. Um these are really challenging times. Um not only do we have everything is shifting, right? We've all been under stress trying to respond and it's um unfortunately has really divided our community in many ways and it's it's that breaks my heart really um because of the you know we were all really really hoping we could just go back to normal school in the fall and um because of the delta delta variant and the increased risk it's um some people are arguing that we even do distance
065education again and I'm so hopeful that we can pull pull together enough strategies that we can keep our community as healthy as possible and we don't in don't cause this these big spikes in in the virus. I um feel like with any other contagious disease, we need to take care of each other and um you know it's if you have um if you have head lice, you don't go to school because you might spread it to others. That's how we're courteous to each other. And um this is kind of in keeping with that in my mind. Um if our public response isn't really collaborative and fairly unified um then we're not as effective. And I'm really hoping that we can still continue to have a dialogue and um um and support especially the most vulnerable
066in our community. we're not only talking about our students, we're talking about what our students could bring home to older people that live with them and so on. So, it's it's um I have chosen to um to support and trust the health professionals that have spent their entire lives protecting the public health. They are devoted to it in a way that that the rest of us can only observe really. They're um working terrible hours trying to keep a breast of this changing situation. They have their own children and their own families to worry about, too. So, it actually kind of makes me, you know, I I trust them. It's kind of like my aunt Eleanor, who is just diagnosed with stage four cancer. Now, she she is Excuse me. Excuse me. Excuse me. No, you're
067not allowed. No, she my aunt my aunt is um battling for her life and even though she has some experience as a health professional, she of course is trusting the medical professionals, even though they're infecting suffering on her through chemotherapy and all these other things because she's fighting for her life. That's her best option. And um I'm hoping no one in our community is going to be biting fighting COVID to that level. But I feel like if there's anyone who really understands this, it's the people that's devote their lives to understanding this. I put my confidence in them. So I um I know that that's why the law has been uh enacted the way it is. I know that's why California Department of Public Health also follows through with the recommendations they have and I
068support all of that. I support our district adhering to those legal requirements. Um I really I really appreciate everybody coming tonight and I actually want to thank everyone for um being very polite and courteous. I I have to say that I am very concerned that you're not wearing masks. Um and I would not and I would like to and I would like to say that um we're in this unfortunate situation right now which is the is that the case numbers are really quite high in our community right now. And if it was, you know, the beginning of the summer there was zero there were zero cases in South Lake Tahoe. The numbers are much higher. They're considered widespread transmission. That puts a lot of us at risk in vaccinated, unvaccinated, children and adults. Um people
069are getting sick and um I happens every year. Absolutely. That's true. Excuse me. We're going to let you guys speak and let her finish. I would like you to speak when it's your turn. Actually, when it's your turn, we'll let you speak. So, I I really do appreciate people are here and and we are here to listen. Um, and it is your right to talk when it's your turn and when your name is called and I and I support public participation and I also support um following the state uh guidelines. So, I just want to make that clear and I think it is important that in order to keep students in school, we need to protect our students and all the staff by wearing masks. Thank you. I would like to just add one thing.
070Um, many of you or all of you know that I read lips. So if I am either reading this closed captioning or looking at the speaker and someone blurts out, it's just noise to me. It's just noise and I don't understand you and I can't listen to you. So when it is your turn, I will give you my full attention and listen, but please don't blurt out for my sake. Anybody anybody else want to speak? I just want to say I am actually looking forward to hearing everyone. I constantly am asking people to email reach out to us board. I personally I want to hear everything whether I agree with mass or not. We do have to think of their greater good and as Dr. Culler mentions the law. But I personally I really want
071to hear everyone. I just don't, you know, I don't want to be yelled at. I don't want name calling. I just really want to hear what you have to say, your beliefs, your views, whatever you want to share. I mean, I am a mom with a kid in this district. I'm not stoked about these masks. She's not stoked about it. You know, right now, you know, in my family, we're following protocol. It doesn't mean I believe in it. It doesn't mean I'm against it. I you know as a trustee I am trying to do the best that I can to support you know a lot of people in the area I live in you know they want mass and I'm like okay why you know I want to know I'm I do elderly care I'm
072trying to help people with disadvantaged you know lifestyles that's what I'm trying to do the mask gets in the way yes but I have to support our school district and our community and the best way I know how to do that is to listen to you, to read what you have to say. I mean, I actually don't get that many emails, you know. Um, people stop me in the store and tell me, my friends will tell me, but I really I'm always surprised that I don't have a bunch of emails. I'm very open to conversations and listening, though, I want to hear what everyone has to say. You have anything else? Okay, I'll I'll sort of tie it up here. I'll I'll tie it up here a little bit with my thoughts. Dr. Cutler and
073the five of us took an oath when we decided to serve on this board. And part of the oath is to defend the constitution of the state of California. Part of that is when we are given a mandate and our lawyers tell us you got to follow that. Our insurance companies say be be aware you have some problems and we are facing a public health issue. I know that for some people or some parents they want to make it a choice issue. I can't do that. I'm going to support California Department of Public Health. I'm going to support the Academy of American Pediatrics who say, "Mask up." We want kids to be in classrooms. We don't want to go back to digital or long-distance teaching. But we're going to have to follow this. The last
074thing I'm going to give you is a quotation from a 12year-old. Her name is Lilia Hartley. She goes to school in Duval County School uh district in Florida. Her board was deciding last week whether or not they were going to have children wear masks. She wrote the she wrote the board masks are important so we can continue to enjoy in-person school and not have to hurt families and school staff by this terrible virus. Mass save lives. That's a fact and that's what I'm going to stand on. Okay. Okay. So, let me do this first. Okay. Okay. Okay, now we're going to go into We do have public comment, right, Dr. Cutler? Yes, Mr. President. Okay, thank you. Okay, we have public comment. Like Trusty Banister, we're here to listen to you. Please limit your comments
075to three minutes or less. If there is more than one speaker on a single agenda item, the board president may limit the comments to less than three minutes. No more than 20 minutes of public input will be taken on one item. We appreciate your cooperation and helping us to facilitate the timeliness of our meetings. Yay. Yay. Yay. Okay. So, please give us the first Can I just also add that I'm going to give a 30 second warning so that you don't suddenly run out of time and feel like you didn't draw to a close. Okay. All right. Mr. President, we have several uh speakers this evening. Um I'll I'll just go right through them in the order that they're in my hand. So, at this time, Matt and Christina, I didn't have a last name
076on that. Matt and Christina. How you guys doing? Good for being here tonight. The Lake Tahoe Unified School District Board of Education based on the presentations, discussion, and questions at your 72021 board meeting and seems it seems that you have been receiving some incorrect information from your superintendent regarding the California Department of Public Health mass mandate for K through2 schools. While it is absolutely true that K through2 schools are at the at this point required to mandate maskearing for students, local school districts have the authority to determine how to enforce such a mandate. The how is the important piece. Signage, communication, even distribution of masks is how. Options for virtual learning is how and ultimately discipline is how. And and it is this last piece that is at odds for many parents. Why? And I
077am honestly asking you to ask yourself why. Why would you punish a child for not wearing a mask? Why would there be any consideration of discipline for a child not wearing a mask? Nothing. And I repeat, nothing in the CDPH guidance requires a discipline process. That language was explicit explicitly and proposably removed. The local school districts and boards given the authority to determine how to enforce the mass mandate. So I would ask again, why? Why would this board want to weaponize the discipline process against students and primarily students of color or latinex population in the LTUSD? When asked at an in-person meeting held with five concerned parents, of which I was one, Superintendent Cutler was dismissive of this very question and gave a flippant response that if the students did not wear a mask that
078they could be removed by the campus by SLT police department against children and again primarily students of color from Latinex communities simply for not wearing a mask. Allow me to repeat that. Superintendent Cutler, seeing his smug privilege, was completely comfortable threatening to weaponize the police department against children if they did not wear a mask. Take a moment with that. So, I will return to asking the board why why do anything beyond what you are required to do require masks. Communicate that requirement post signage informing students, staff, and faculty or that requirement and provide masks to those who do not have them. Why further traumatize students with threats of discipline or arrest? I assume you the board is up to date with all the research, so I will not dwell on it. CO 19 is not
079a pandemic for children. Both the state of California and Elorado County children under 17 make up 0% of COVID deaths. And that's online. That's at your guys's official website, sca.gov. You You have 30 seconds. The risk of severe illness in children is also incredibly small. Parents need to be more concerned about summer swimming pool drownings than they do about COVID 19 risk for their children. Yes, adults, not children, can and should get vaccinated. I am vaccinated. Historically, vaccines have worked. Remember, children are are in a position where they are damned if they do and damned if they don't. Children do not want to disappoint their parents by not standing up for their rights, and they do not want to be deemed defiant by the school for standing up for their rights. When you come up
080with enforcement policy, you need to stop thinking about yourselves. Stop thinking about the parents and start thinking about the children. Independent study is a punishment to many of these children. [Applause] Oh god. Are we gonna Yeah, Mr. President, are you ready for the next speaker? Yes, I'm ready. All right, Roxan. I apologize. I believe it says Bruce. Roxan, I believe that's what the name said. Okay. Hello everyone. Um I think first of all um there's a lot of discrepancy between u medical professionals because there was so much discrepancy that to be able to say you're following the medical comm you're following what big pharma dictates to you to do. That's not what's in our best interest. And um you guys treating uh COVID like a pandemic when like it like it's a plague. who there
081hasn't been enough deaths to treat it like it's a plague or a pandemic and it's less than 0.05% children have died and few even have complications. So there's really no purpose to wearing a mask except to make them feel nonsocial and it's basically social deprivation is what you're doing. You're taking away all their social activity with their friends while they're here in school. they still can't be social because you're depriving them with their masks. So basically, not only are you doing that, but it says right here, and this is from American frontline doctors, that clinical researchers are urging policy makers not to require children to wear face masks after finding that such masks cause a rapid buildup of carbon dioxide in the air breathed in while wearing masks. They also say they found that within
082just three minutes the level of carbon dioxide present in the air being breathed in by school children wearing masks was six times higher than the legal limit of point of 0.2% carbon dioxide by volume. So you're actually making them breathe carbon dioxide which is we all know is a poison and a toxin. So, you're actually ba making their immune systems be lowered by wearing these masks. And common sense tells us uh most people always uh try to make sure they can breathe whenever they're in a situation where they need to breathe. So, wearing masks is actually counterintuitive and not intelligent and doesn't even uh have anything to do with common sense at all. But regardless, it isn't anything that the majority of medical uh people agree to. It's just you just want to follow uh
083Fouchy and CDC and Bill Gates, who's not even a doctor. But the bottom line is Fouch's contradicted himself several times and so is the CDC. I actually have watched I have watched them speak about how masks did were negligible and did no good whatsoever. And then I've sort of heard him turn around say, "Oh, but now we're going to wear masks." Fouchy said, "Oh, don't wear masks. It doesn't help. It's negligible." and then he turns around and says, "Oh, let's wear a mask." They contradict themselves. There's a lot of research out there by frontline American frontline doctors and a whole bunch of other uh doctors out there who have made it abundantly clear that maskearing is detrimental. That's right. Okay. Next is Laura Lightner. Hi everybody. This guy's gonna be my cheerleader. Isn't repeating history
084fun? Do you know what indicator was used to test the population for compliance? Toilet paper. Toilet paper. The mad rush for toilet paper. At what p at what point do we say shenanigans to the flagrant abuse of power before us? I am here speaking on behalf of my friends, my family and my community. I belong to no pack group of political party. The people have long forgotten that it is our responsibility to assert our rights protected by the constitution. We became entertained and complacent. We forget that every time in history a government has pro promised safety in exchange for expanded powers, it has ended in the death and enslavement of the people. This is not a life left versus right political or health issue. This is a war between good and evil. We fight for
085the future of humanity and the future of our children. Everything that is happening violates our human rights and our constitution. It is time to take a stand and protect our city and our children. We have the law of the land, the constitution on our side. The ninth amendment states, "The enumeration in the constitution of certain rights shall not be construed to deny or disparage others retained by the people." The 10th does not supersede the ninth. No one is, and I quote, I got it. No one is bound to obey an unconstitutional law and no courts are bound to enforce it. The general rule is that an unconstitutional statute, whether federal or state, though having the form and name of law, is in reality no law, but is wholly vo wholly void and ineffective for any
086purpose. Since unconstitutionality dates from the time of its enactment and not merely from the date of the decision, so branding it. An unconstitutional law in legal contemplation is as inoperative as if it had never been passed. That's from the 16 American juristprudence. We, and I quote the declaration, we hold these truths to be self-evident. That all men are created equal. That they are endowed by their creator with certain unalenable rights. That among these are life, liberty, and the pursuit of happiness. That to secure these rights, governments are instituted among men, deriving their just powers from the consent of the govern. We the people do not consent. Compliance to tyranny is feeding the alligator hoping hoping it eats you last. You cannot help you cannot help the snake and not expect 30 seconds. The people are
087coming together and we will be with you as you stand with us against tyranny. All of our voices will be heard around the world. United we are unstoppable. Thank you. I'm going to ask one more time. Will you please show some decorum? We want to hear everybody. Okay. This is not a political assembly. You're coming here to help us try to understand your point of view. But we cannot do that by people yelling, screaming, so forth and so on. So please, we are willing to listen if Okay. Okay. I would hope we would take notes. Okay. Mr. President, you like the next speaker, Michael Myers. Oh, we're gonna get Yeah. Well, my name's Michael. I'm a musician and uh let's see here. We do like you guys still do uh science projects like science fair.
088So I was thinking like would it surprise you if sometimes like Duracell batteries outlast Energizer batteries and then would it also surprise you if sometimes Energizer batteries outlasted Duracell batteries? So like if we had two two kids, two bright kids in our school district and one came to discover through their science project that Duracell batteries lasted the longest. And then on the other side, we had another bright kid who discovered that Energizer batteries actually last the longest. Did that surprise you? Would that surprise you? Okay. So, I think I think what's surprising to me is that like we don't seem to have we've come to discover that a bright scientist named Dr. Fouchy has has claimed that like masks are very effective. Yet yet, yet yet, hold on. Yet, we've also discovered that there are
089thousands of public health scientists and medical experts who have come to discovered that masks don't actually help that much. And I'll just name one for you. Are you guys aware of the Great Barington Declaration? Okay, so these are these are some some of the top epidemiologists in the world. I'll just name three of them. the ones that drafted it. Um, one is one is Dr. Sinptra Gupta. Sinptra Gupta. I think it's she's Indian, but she's been teaching at uh Oxford. That's right. Oxford in England for for longer than I've been alive. So has Dr. Martin Coldorf who's been teaching at Harvard. And so has Dr. Jay Bachara from Stanford. and they've all drafted this. Go ahead and look it up. Please take notes on this. Uh it's the Great Barington Declaration. And I'd invite you
090to look it up. And I would also hope that just because you you come to hear that some scientists claim that masks are very effective that you wouldn't decry the reputations of these medical experts who have been gi also given their lives to the pursuit of science and a more whole truth. The other thing that I would say is is in regard to CRT. Okay. And I think it's important to talk about both because we have CRT and then we have colorblindness and color blindness. 30 seconds. I I'm sorry. I'm going to have to be heard out here because this is super important. No, three minutes you're done. Co colorblindness is has been decrieded and defaced recently and mostly it's because we don't want to claim that injustices don't exist. If you're color blind, like
091are you blind to injustice? That's not that's not what color blindness originally meant. That's three minutes. What what color blindness actually No, no. I'm sorry. We're going to move on. I'm going to slide into home base here. No, no, there is no home base. You're done. No, I'm not. It's It's Hold on a second. You're doing a different topic. You need You need You're done. Give me a second. Okay. So, this is just fairness. I'll just talk to them since you can't hear. No. Okay. Color blindness actually means that is that like rather than being blind to injustice, which none of us want to be blind to injustice, right? What colorism originally meant is it's not it's not the uh the organ or it's not being uh No. No. Okay. We've lost this. If we're
092going to continue this, I'm going to move to another agenda item. That's my prerogative. Okay. Just Okay. No. No. You're done. Okay. To the board. I know. Yeah. Okay. Would you like me to continue? Yes. I think we can. Okay. We'll we'll we'll try one more if they can stay within what we're doing. If not, I'm gonna move out of here. I think you you should come back another time when that topic is relevant. All right. That would be another public forum, Mr. President. Okay. So, give me another one. Okay. We're going to move on to uh Terry Tererry. Terry Tererry. Okay. All right. Um, Wendy Stevens, thank you for listening to all of us. I am a mom and a grandma and I'm an enrichment service provider for local charters here and I've been
093working in that capacity for many years. And this year I have had between 25 and 50 students in my home classroom. I have not required masks and none of the children, none of the parents have been infected. We have washed hands. We do take supplements like vitamin C and vitamin D3 and echynasia. And if parents have noticed that their children have symptoms like a runny nose or a fever or a cough, they just call me and say, "I'm not going to bring my children in today or my child because it's wisdom to, you know, protect your child and protect others." And they have done that. And they can even take the child's temperature or if the child's vomiting. I mean, we know these things, right? And we wash hands and I, you know, wash the
094desk. My children have had snacks. They have shared snacks. They have given me snacks. My own son who's 22 who was home from Berkeley was um infected with COVID. I increased his dose of vitamin D3 and he had a dry cough for a little while. He got over it by himself. He's an adult. He's not even a child and he did not suffer. I cuddled with him on a couch on his mom. We had his germs all over the house. I washed his dishes. I never got infected. I nursed a girlfriend of mine who had COVID and I never was infected. I slept in a hotel in a queen bed with my girlfriend who had COVID and I nursed her to health. I never was infected. We rely on our immune systems. And when you
095take good care of yourself, you may not just because you're an elderly person like myself at 56 almost 57, you may not succumb to this virus. We don't have to be afraid of it. That's my personal opinion and it's been my observation. And the people, my girlfriend who is 68 who got COVID and who I nursed, she um was given hydroxychloricquin. She turned around in 24 hours. She's fine. She's more elderly than I am. And I think if everyone believes that their masks work and their vaccines work, then they should not be afraid of children. If teachers and staff would like to wear their masks and would like to receive vaccinations, they will have protection from the children. The children aren't in danger. And it would be my counsel to you to consider that. And
096parents are so alarmed by the potential mandates of both the mask mandate and vaccination mandate that they're fleeing California. They're fleeing the public school system and I'm working more than ever trying to provide service for public school children who would rather That's your three minutes. Thank you. Wendy Stevens. That was Wendy. Oh. Oh, that was Wendy Stevens. Gosh darn it. I just didn't put it down. Thank you. Sorry about that. Brandy Griffith. Oh, okay. Um, Sherry Eddie again. Um, first of all, this is a a mask mandate. It's not a law. It's not passed by the state legislature. So, therefore, it's not a law. Um, we need to defend our children and our teachers. Teachers and parents of school children should have freedom of choice on whether or not to wear a mask indoors. And
097they should not be made feel to be uh to feel bullied or left out if they choose not to wear a mask or choose to wear a mask. If you read on the box that masks come in, even the ones at Costco or other stores, the ones provided for daycare uh providers, it states on that box that it does not these masks do not protect against viruses, illnesses, or even death. Smoke particles are able to get through the masks and the co virus particles are much much smaller. As I stated in my previous email for the last schoolboard meeting, um it has been proven that masks don't work. Yet, it has been scientifically proven that they deprive people of their oxygen while breathing in their own carbon dioxide. My daughter gets severe headaches, severe headaches
098from wearing a mask. And she gets a rash on her face from wearing a mask. Clean new masks by the end of the school day that have been tested have shown bacteria that pneumonia virus and uh other bacteras were inside the masks. Masks are very unhealthy for the brain, body, and it is even breaking down the immune system. That is stated by many doctors. That is proven science. Our Elorado County Sheriff has stated that he is following the United States Constitution, not the mask mandates. So, our school board should protect our Constitution and our children. For the bodily health, mental health, and emotional health of the children and teachers, please let them go back to school without masking their faces and being able to breathe the oxygen that is needed for their immune system to
099stay strong. If they choose to wear a mask, they should be able to do that. Also, masks should be a personal or should be the freedom of a personal option and choice. I know many vaccinated people that wear masks that have contracted COVID 19 and many that were hospitalized. They survived. It's a 99% survival rate from COVID 19. If you had a 99% survival rate from from cancer, would you still do chemo while not having been diagnosed with cancer? My relative is a nurse at a hospital. This is shocking. She let me know that they had COVID patients, several CO 19 patients that were vaccinated. Corporate told them they are not allowed to put that in the papers in their charts. So I also know people that faithfully followed masks. They faithfully cleaned everything. They
100had their social distancing. They got CO 19. They survived. It was like a horrible head cold with a flu symptoms. Um, you know, many doctors that speak against this propaganda have three minutes from public viewing. Every year people and many die every year. Uh, ironically since 19 there has been no influenza deaths. Thank you. Question. How come we get three minutes, but when people are up here for business, services, and operations, they're up here for a long, long time or for anything else that's on here, and we get three short short minutes. Five would be good. We could get it all in. So, please take that into consideration. Thank you. All right. Nikki uh Florio. Hi there. I'm Nikki Florio. Um I'm the founder and director of Be Heroic and also the co-founder of the
101CR Freedom Alliance. Um we work with different physicians and scientists groups. Uh we've presented at different conferences and hosted some with um members of America's frontline doctors uh and the World Doctor's Alliance. We work with physicians and scientists and psychologists. Um, putting a single pediatrician up here is nothing compared to the thousands of physicians and scientists that are exposing the fact that COVID is not harmful to children in a general sense. They develop flu-l like symptoms just like they do with all other symptoms. Now, regarding masks, um, uh, at 6:23, Mr. Cutler touched his mask, did not wash his hands or change his mask. At 6:24, this woman touched her mask, did not change her mask. At 6:26, the fellow over there mask did not change his mask. Um, the young lady with curly hair
102right here, um, she moved her mask to cough in her hands, uh, and then did not get up and wash her hands or change her mask. Then she coughed again at 6:50. at 6:46. Um, I just have blind chick with glasses. Sorry. They they touched their um I I apologize. I don't know most of these people's names. At 651, um at 6:51 uh she removed her her uh she straightened her hair and moved her uh mask. At 6:52, all three people on the end got drinks of their water. They move their mask with their hands, fully touching the inside of their mask. 658 um Larry touched his mask as well. Um uh and uh at 7 o'clock, Larry did it again. At 7:07, he touched his mask again. At 7:08, he touched his mask. At
1037:30, he touched his mask. At 7:33 on his mask um and and these are adults. This is only a two-hour period. Children are in school all day. None of these people have changed their masks or washed their hands. She came up here and contaminated. She just touched the inside of a mask again. I mean, do you see how ridiculous it is to have children? So, so aside from that, um the the fear mainstream media is extraordinary. It's just like just like the 911 fear-mongering. There's certain terminology that people use with this. It's deaths, COVID, COVID 19 and and all of the things. Cases, cases, cases. So, for the first time in medical history, because deaths went down, they started counting perfectly healthy people that happen to have the virus in their body, cases. And that's
104how they have extended the entire pandemic lie. That's three minutes, [Applause] Mr. Mr. Go ahead, Dr. Color. Yeah, Mr. President, that's all the recent card. Okay, we will move from 11.4 to item 12, consent agenda. We need a motion to accept the consent agenda. So moved. Second. All in favor say I. I. All opposed. Okay, let us move now to item 13. items for consideration of future board meetings. Okay. None. Okay. Okay. So, let's move to item 14 and that is a German. Thank you. Well, thank you. I did. No, it's
