001all right good evening and welcome to the regular board meeting for December 11th 2023 we are about to head into closed session um before that it looks like we do have one public comment for our closed session so Mary Hard toy have one I could say one two three eyes on me good evening members of the board I'm Mary Hardesty it's it's nice to be here and see you because I I watch all your all your meetings on Zoom so it's nice to actually see you live and in person um I'm here um representing the Martinez Education Association the mea I'm the co-president with Mary writtenhouse um as an educator in Martinez our focus is what's best for students one thing we know for sure is that what is best for students is to have

002quality Educators working in our district in order to make that happen in Martinez we me we need to make sure that our salary and benefits are competitive and unfortunately the last offer from the district was not competitive with surrounding districts as we head into the second half of our school year we still have vacant positions because we have not found qualified Educators to take them this is not what's best for the students in Martinez the bisha school district has settled for 8.22% the Castro Valley school district has settled for 8.6% San Leandro is settled for 10% all these settlements will attract Educators to their districts Martinez with a 3% offer will not be attracting Educators to our district which is not good for our students mea asks that the district reprioritize their spending and keep

003in mind what is best for students at this time mea has taken a strike authorization vote this does not mean that we are ready to strike however it does indicate the support from our members that they are willing to go all the way to get what we need for the betterment of our students last week we pulled all of our teachers and we had a 98% of our membership indicate that they are behind our bargaining team with this strike authorization at this time um we would like to give you um a copy of the presentation we presented to the community last week in this presentation you can see where Martinez stands in terms of salary with some surrounding districts you can also see that while we did receive a 19% salary increase over the last

004two years the two years before that we received zero all we ask is to keep Martinez competitive by passing the cola along to the Educators so that we can continue to provide the best possible education to our students in Martinez thank you very much so we can pass those around thank you thank you okay so at this time I don't see any further comments we will adjourn to close session and we will be back shortly at 6:30 p.m. good evening and welcome to the regular board meeting for December 11th 2023 we are coming back from our Clos session and we have nothing to report out if we could all stand and join me in the Pledge of Allegiance please ready begin I pledge allegiance to the flag of the United States of America and for

005it stands right so for those following along with the agenda we're on item seven approval of the agenda do we have a name oh I'm sorry yes we do have a member uh joining us remotely thank you so uh member Mella O'Brien is with us and um is can you tell us if there's anyone with you at your house Court okay thank you okay so approval of the agenda is there any discussion oh are there any changes to the agenda yes there are I'd like to add item 8.3 approve wait a minute I'm going to call it uh schedule of regular meetings and governance calendar and this is added and there are copies in the back and there's also a copy on your desk of both the listing of board meetings through next December and

006the governance calendar that we've been following all year there's um you wrote January 16th and that's actually a Tuesday I know oh okay but we're not there we're not there yet oh gotcha okay y thank you okay so we'll get to all that when we get to item 8 .3 which is new okay any board discussion do we have a motion I'll move to approve the agenda I'll second and since we have a member participating remotely we do need to do everything as a roll call so I'll start with Courtney so we're on item seven Courtney what's your vote okay oh actually should sorry I'm sorry I should have started with student vote I apologize Marisol I sorry we'll go back to you Courtney just so I get this procedurally correct okay um oh sorry

007the motion needs to be made okay you know what we're just gonna start this whole item over okay so Carlos when we make the motion we have to make an as amended I make the motion approve the agenda as amended I will second and now we're going to do this part right Marisol I Court Whitney Yasmine I Tanya I Carlos I and I'm I okay motion carries number eight organization of the board procedural item so how this is going to go so there's three procedural items and the first is the election of board officers so what I'm recommending is that we do the all of those the board officers and then move seats as necessary after all three of those and then we can move on to two and three so we have the um

008the first one up is one 8.1 a for president so we can do a discussion of these um I'm ready to make a motion but um but we can do you're you're doing a nomination so if you want to make a motion it's a nomination or or I guess anyone can make a nomination that we can discuss and then take a vote President Martin uh if I may may ask for just a moment um I need to move trusty O'Brien into a different part of the meeting because we're not going to hear her audio on the live stream okay so would you be okay of just giv me a couple minutes so I can just work with trusty make a a motion I will move to adjourn for I need five minutes five minutes fine

009second student vote I Courtney yasine i t hi I thank you I appreciate it [Music] okay yeah can you can you hear me can you hear me all right we are back we apologize for the technical difficulties we are this is the first time we've had someone participate remotely in quite some time so we're just working out a few Kinks we are so we're on 8.1 so we can any member can make a nomination and then we can discuss any nominations that come up and or anyone can then make a motion to um elect that person into office so the first up is 8.1 a which is the president position and I will nominate Courtney Mel O'Brien any other I'll add I think since Courtney has taken the training the requisite or the uh preferred

010recommended training through cspa for the role and position that I would would uh I would endorse that any other discussion on this one so I will well I'll say a little more I think that Courtney is going to be great I think she has done a lot of the training she went to the csba training as Carlos mentioned last year to prepare for the president position when she came into the vice president position and she also attended the legal Symposium this year which I think was probably really valuable for this so I think she's very prepared and I'm excited to see how she um handles this position so I will motion make a motion for member O'Brien to become our next president second all right Marathon wait do I say I I wait wait yeah

011student vote first Courtney I thanks everybody yasine i t i Carlos I I okay motion carries congratulations Courtney 8 point 8.1b is for the vice president um I would Rec or nominate Carlos for the vice president he was the clerk and he's been on the board also a long time so I think he's would be a perfect person to be in that role thank you there any other nominations I um I think Yas Meine was interested as well so I was going to nominate her so maybe we should just have a discussion about it okay um I mean I think Carlos has has been on the board longer so and has done the clerk position so traditionally we kind of take these leadership positions and then they have not that they have to do this

012but they have kind of the clerk becomes vice president vice president becomes president um that's how it's traditionally been um but I think that Carlos has you know dedicated himself over the past few years and I think that he is ready for this position yeah um ex said following the guess the tradition of the board I'm prepared to take the step to the vice president and um and fulfill those duties and do what's best for the district okay any other discussion or do we have a motion I'm I'm just concerned um with putting Carlos as vice president because of the stance that he's taken on critical issues with the district and I would not be comfortable voting for him to be vice president um because of the way that he stands on certain issues that

013are very important to me [Music] any other discussion comments I think Carlos has um expressed his opinion but at the same time he has um I think his thought has always been to do the right thing and um eventually he did come to the right verdict or he CH he went along with the board I mean I think he gave an opinion but I think he was um open to hearing other uh items or other viewpoints and ultimately um came into that came to the vote that that the board also came to so I still think um and I I think he has you know he has he's been on he's been a clerk and he has um he he seems to really um spend the time and ask educated questions for budget and things

014like that so I think that's a critical part to to Really um be informed and I think he's pretty well informed well I don't think it's a surprise to anyone that Carlos and I don't agree on everything and we've in fact had that conversation lots of times and it doesn't change my opinion that I think he's a really good board member in that he does take the time to educate himself on is isues and I'm also of the opinion that sometimes you know a healthy discourse is a good thing and sometimes he brings his views and that makes us think about things in a different way and even if we don't ever you know land at the same place I certainly don't think that for me that doesn't disqualify him from having a leadership position

015I think it's good to have a wide range of opinions and thought processes and and backgrounds I mean we're all from different professions we have different backgrounds I think that everyone's bringing something unique to the table and I think that's that can be something really valuable and I've always felt like even when there is dissent Among Us that it's been really respectful and so I've always appreciated that I I'll say that um and you guys can hear me okay yeah yes okay great I can hear everybody good so this is great thank you for I know I created extra work for you all um don't know what we're doing but we're we're working on it um I hear what yasina is saying I also agree with what Tanya said to me the most important thing

016is um I I I don't think we all have to always agree on issues um you know I obviously i' I've made pretty clear what's important to me Priority wise on the board I'm not usually afraid to speak up but it's also really important to me that we work well as a team um because as we just saw in our you know the workshop we just did like those are the really important things that we all have to come to a a consensus on so which doesn't mean it has to be a - consensus it can be a 3-2 consensus or a 4-1 consensus but um in order to um to do those things is you know we don't always have to agree but we do have to respect each other so just wanted to

017put that out there is anyone ready to is any other discussion or um I haven't been on the board long but I do feel like Yas Meine would make a great fit she does have some really good point of views that I feel like Carlos wouldn't have um you do make a really great Clerk and I just would like to see someone else in a different in a in the position with a new perspective on the district thank you anyone ready to make a motion well I will if no one else wants to make one that doesn't mean it has to be the only one but um I will move to appoint Carlos Melendez as our vice president seconded okay student vote do I do I agree you can no Courtney yes Yas Meine no

018son yes caros hi and I'm an I also so motion carries congratulations Carlos and 8.1 C is for the position of clerk are there any nominations I would like to nominate yes me okay and I would like to nominate Tanya and my reasoning behind that and then Courtney we can you know have it is are there any other nominations I was I was gonna nominate Tom Tanya okay so my reasoning for that is um the clerk the really the the most important thing is being here to sign things and I'm pretty sure that Tanya is the only one of us who has perfect attendance in the last year so she seems like a very reliable fit for the position of and this was you know I mean Tanya and yaasin you were both elected at

019the same time I know you both put a lot of work in and so for me this was like the one um like factor that I was thinking of is like how can you know what's what's important for the clerk position and attendance seems like a good one yeah I'll Echo that and uh I think her interest in a desire to do more and involved with the board is is demonstrate itself so see you as a clerk yeah and you know I I nominated Yasmine because I know she's interested in a leadership position and I think she would do great in any of these positions and this is really hard because we you know because of the brown act we can't all talk to each other so I don't really know like who's interested in

020what position um so I am by all mean like I am by no means saying that I don't think Tanya would do a good job at this I just think that yasine would do a great job also I just want to add that I was the only one elected by voters everybody else was appointed so want to distinguish that that's Courtney and I were both elected by voters oh between you and between Tanya and Carlos okay I think that's a good point actually okay any other discussion I'll move to nominate Tanya I'll second student vote I courtneyy yes yes me i t i Carlo I I all right motion carries so um Courtney's not here um in person so we have to decide how court can you tell me how you want to proceed with

021the rest of the meeting I would prefer if you kept running it if you're okay with that just because um I I just feel like it's not going to go as well with me not there and also I'm just kind of not really feeling up to it okay if that's okay with everybody okay is that okay with everyone just finish out the meeting as is we can still move should we I think we should still move seats um and or should why I guess not because I have to be here so we'll just move is everyone okay with that and we'll just move seats we'll have everything positioned correctly for the next time okay perfect then we will proceed that way and not make you do extra work Courtney so we're on thank you if

022you're welcome uh we're on 8.2 which is establishment of committees so I think um do we have the list of committees that we can pull up for everybody yes and I'm going to do that one yes and I also wanted to say that at the next meeting I have to be voted in um as the secretary according to the the uh bylaw so we'll do that at the next meeting okay thank you in front of you you have last year's list of um representation or board committee participation with the two two board committees being the city council board and curriculum advisory those two are board committees because they follow the um Brown act okay and they're uh um they were put together by the board the contracosta school board's Association the Martinez Education Foundation and

023the liaison to supervisor Glover's office are all representation so you you uh it's not a board um Brown act um oh my gosh committee it is uh just representation to those uh different agencies on the other side is the superintendent advisory committees and a few years ago the budget advisory elcap District technology and athletic Finance were all combined into uh one because we don't have very many of the um District technology or athletic Finance we also have our health and wellness committee which meets probably once or twice twice a year we have our facilities advisory committee that meets one per semester something different so um maybe we can handle that one first is anybody in objection to um is there Annie you want to take s you discussion about yeah I think there any objection

024to changing the name to diversity equity and inclusion committee okay so we can change that what we're going to do I think and Helen's going to explain this but we'll fill all of these positions and then make one motion to pass the whole thing so we can make note that we're changing the name on this and then it'll just be noted as part of the entire vote okay so um currently we'll start at the top at the board represent uh the board and city council committee they meet twice a year although both of our times this year will be in the second semester because of scheduling conflicts for the first semester so this year this year past we had Yasmine and Carlos and with Tanya as an alternate do I um is anyone interested in

025um a seat I need two represent representatives in one Al alternate Helen I am this is Courtney okay uh of course I'm interested in staying on that committee but obviously it's my second go round so I understand if there's somebody else that would like to yeah two times okay how about um an alternative an alternate sorry so if I if I have Carlos interested and I have Courtney interested I would like someone to be an alternate it could be the alternate so Tanya you're saying you don't want to do that one anymore are you ready to move on no I would do you want to stay the alternate or you I'll say the alternate sure okay okay okay curriculum advisory Council and um currently we have Annie and Courtney who is the alternate but Annie

026is the regular attendee and this committee is is important in that you uh meet I think it's is it monthly I don't think it's monthly it's it's four times a year and they make decisions they listen to presentations from staff and administration on the different curriculums different courses textbooks so on and so forth for the district um if you have any interest at all in that direction um curriculum does Drive the direction of the district a lot of times and um or most times and it's a very important seat that we need to have someone in an alternate um want to sit for so and and another thing on that and Amy you can clarify on this but it has they have a two-year limit right on the yes so I'm in my second year

027so I don't think I would make it to next December without expiring out so I don't think that I should be the person I actually really love this committee and I was on it as a teacher also and I think it's fantastic but I you know we want to be following all the protocols so I I think I do actually have to get this one up I I think that's true for me too I think I've been the alternate for two years also anyone have an interest as me alternate I need an alternate okay so we have yasine and Tanya as an alternate we have the Contra custa County School boards Association currently we have Yasmine and Courtney as an alternate is anyone interested in that I think they meet it's not once a month

028is it it's it's less than that and it's at the County Office of Ed or virtual you can zoom it I've gone in person you can zoom it and they have guest speakers come and talk about pertinent uh things that are pertinent to education like the budget I went to one on on um on uh trafficking sex trafficking of teenagers um they just uh it's all the local school boards in the county so anyone interested are you interested in staying on that you do okay Courtney you want to remain the alternate or you want to give that up um I I if nobody else wants to do it I'll I'll remain but I I usually it just seemed to work out the past year that I was never able to go to the meeting so

029if somebody else wants to that might be better it's been one of my concerns why I won't volunteer because every time I've wanted to go I haven't been able to right yeah they're like on Thursday like early evening usually I think I can be the alternate okay so I have Yasmine as the representative with Annie horac Martin as the alternate okay MEF currently we have Annie um as our representative with Carlos as an alternate and MEF meets in the daytime mostly at 12: noon to 1:00 right here in this district office or to 1:30 so I'm pretty deep into work with them and including a new initiative that is taking up a a ton of time so reg I think that doesn't preclude someone else from joining but I will even if someone else joins

030I'm like I'm pretty I can't quit on them at the moment so um so I'll be all stay um but I think their bylaws are like we don't I don't think it I think someone else could be on it if they wanted to too but I'll say does anyone want to be on it or an alternate I I haven't done much for the alternate R so I don't know if anybody else wants to participate in how often did they meet so they meet once a month and what they've been trying to do lately is one meeting in the afternoon it's like 12: to 1:30 and then another meeting um like the next month it'll be 4 to 5:30 just to try and get people able to participate [Music] more I can be the alternate if

031nobody else wants to if did was Tanya saying she wanted to no okay then I'll do it okay so I have Annie staying continuing her seat on the MEF found U MEF um committee and Carlos um as the alternate okay we have the liaz on to supervisor Glover's office and I T how many times did you meet with supervisor Glover um is there someone who wants to assume that represent representative role do it okay so I what's that oh good so yasine will be taking um that liais on position and over to superintendent advisory committees we have the elcap committee which is the main Committee of the budget advisory District Tech and athletic Finance currently we have Courtney who sits on that committee with Tanya as an alternate it's a very important committee we um

032work on that committee uh to accomplish the goals of the district which are lcap goals you take a look at data to decide uh what's working what's not working and suggestions for improvement or new dire ction um do we have anyone who's interested Courtney are you interested on staying I think you've been on a few years I think I yeah I think this is my second year and I don't know if I can I stay on it you can but we maybe somebody else would like an yeah I think it's a really good way it's a good committee to be on just to learn how things work so somebody else should do it if you can yeah I've I've actually never served on elcap in all my years as a teacher and then here so

033I would love to if no one else is interested or if you want to move from the alternate position and then I could be the alternate I can alter yeah I'm good with that is everybody okay with that anyone else um Annie and then health and wellness they meet once a once a year and Annie is the um representative and Courtney is her alternate does anyone want to sit on that uh committee that takes a look at in um um food service and something food service and and health plans was something with the nurse come on help me out here Bud he's looking at me like he's never done it before yes something with the nurse we talked about aeds and we talked about just overall health and and safety right and and there's a

034a a proponent that goes along with our food service um policy that we meet we take a look at food and nutrition especially if we have to renew the contract of our um selected vendor which is Chartwells and I will just put this out there if you want to do it Carlos I will let you but this was a committee that no one wanted to take and Andy had to beg someone to do it last year and I did it and it was fantastic because Chartwell came and they fed us and they did a whole thing and it was like the best they meet one time a year and they feed you and it's wonderful so I I wasn't going to I wasn't going to let that be the reason why someone joined but now

035it it was a great meeting and and also was really informative we looked at all the menus at the elementary schools what they're doing so it actually was very cool and once a year so if you really want it I could um be the alternate but I might come anyway between that and the um I think I I'm interested along with the along with the IPM committee and with a another idea I've got bounc around my head since the uh conference which I'll share in the update but um sure I'll be happy to okay okay so we have Carlos and Annie or okay facilities advisory committee um we have Carlos and Tanya and they meet uh two to three times a year depending on what's on slate and I know they're overdue for a meeting

036but we've been busy wrapping up John sweat so we will be meeting soon to talk about how uh to allocate our funding and our state allocation money that we have received I'm happy to stay on that one Tanya I was never invited to the first one so I've actually never gone to a meeting but um I would be interested in being on it you want to stay on anyone else have any interest get invited this time you will be invited okay thank you does anybody else have an interest on the facili okay so then we keep Carlos and Tanya we have deac which meets one time per month and that's Carlos and Yasmin as an alternate do we have anyone interested in or Carlos do you want to stay and if not is there someone

037else interested in taking the lead on that committee the heart is willing but the schedule is weak and so that is a tough one for me to get to on a regular basis so I'm happy to offer it up if you guys in the morning usually around in are they like 9 or 10 in the morning Janelle do like yeah I can do that one unless um do you want to become the regular or do you want to stay do you want you want to go regularly okay yes me do you want to stay the alternate in attend regularly the alate and then I can attend regularly is there an alternate someone who wants to be an alternate for the delac committee okay I should be able to go though so I don't think I'll

038have to call up on you okay and then we have our our newly named um Dei committee versus the racial Equity committee as listed and we had Annie hork and Yasmine um yamas with Tanya Breer as the alternate I'm interested in in being on that as a non- alternate okay anyone else I would be interested in being an alternate on it you can have it okay so um Courtney wanted to be an alternate so we have Tanya on and who is the second person Annie Annie because Courtney wanted to be the alternate okay um do we have the policy committee it's on here in my handwriting it's not on the official one we have a board policy um advisory committee that Tanya and Carlos currently sit on and they meet with me hopefully quarterly when

039csba updates the policies but everyone in a while they throw in another month worth um and basically um if any of the board has questions they can give them to them about you know give them to one of us and we can discuss it but they look at the work the changes and make suggestions or approve so or have questions happy to say is any is that okay with everyone okay okay okay check for alternates okay so I have every position filled so Annie want to go about a motion okay so we can well first do we have any oh public comment public comment on the new committee positions okay being none we can make a motion to approve the new committee assignments and the name change for the Dei committee previously known as the

040racial Equity committee do it move to approve the committee placements and uh revise committee name second okay nisol I Courtney I Jasmine I Tanya I Carlos I I all right motion carries 8.3 this is an addition to the agenda approving the schedule of the regular meetings for the Board of Education Helen I'll let you explain this one too okay um so when I reviewed the board uh bylaws I noticed that we had um also had to approve our our schedule of regular meetings last year the board voted to continue on Monday nights with a 6:30 p.m. start time is there any interest in changing that from anyone on the board how about Friday nights Marisol but um sorry I had to throw that in there this uh um so Monday nights at 6:30 stands and

041the board um meetings are listed on our website you have a copy in front of them their copies in the back because this is um an added item and every one of them works except until you get to November and November of 2024 um the board meeting falls on Veterans Day so and the next one the second and the fourth are Veterans Day and Thanksgiving uh break that we have so what we will do is we I have 10 ly put in November 4th and 8th the 1st and the 3 and when we start next year in August I will bring this item forward to the board to see um about changing the dates officially okay so all of the other dates and it on the list it says Monday November 4th pending approval by

042the board and that's on this page that looks like this okay is there another date Katan that was in question no I was just saying saying it says Monday but January 16th is actually a Tuesday because that was a holiday oh is Monday the is the 15 Martin Luther King Day yes and that's so that should have Tuesday it's got to say Tuesday and that has to say pending approval no oh it was already done okay that's Tuesday okay sorry so I have that and then the second part of it is the governance plan which I gave to all of you last August before the school year starts and it's basically to to make sure that I cover the um main points each month on the agenda and um there's copies in the back for

043those that want to see it and I think we do a pretty good job hitting these as we go through sometimes I have to move them around a little bit depending on on how pack the schedule is but for the most part this is how we build our schedule um on Wednesdays uh with the board president so that is uh all I have there so make a motion for approving the calendar and the governance plan any public comments on this okay I'll move to approve the calendar and governance plan seconded Marisol I Courtney i y i son I Carlos I I motion carries okay nine I think this is the latest that this has ever happened um but here we are an hour later Marisol with your update from our [Music] schools so at lasas

055career all right thank you anything else you want to add about these last couple weeks or [Music] finals no all right well good luck to you on all your finals and have a wonderful break because we're not going to have another meeting before that happens so uh okay employee organization Point reports were on item 10 I don't see any with us today 11 is comments from the PTA I don't think so okay 12 is correspondence do we have correspondence tonight there's no there's no correspondence okay 13 is Staff reports and we'll start with you superintendent Rossy okay I was going to um wait and do the uh the um csba conference Report with the rest of you but I did attend um some very interesting sessions there um being as I'm in the mood for

056construction in John sweat opening this weekend I think one of the um most interesting one that I attended was the workforce housing um session where districts like Jefferson um Jefferson Union Santa Clara and Los Angeles I saw what they did with their property and in terms of providing housing um for staff as a priority and then um you know community members low inome and so on and so forth and um the new laws that are coming into effect January 1st to facilitate that that have to do with uh zoning and CH you know usually you have to change the zoning that your property's in to be able to to build and and uh the laws are changing to make it a little bit easier on school districts who have um gone through this already like

057the three Pioneers that uh already went through it and I just found it interesting so and I know that um we have property uh but we also have a very important part of the district our adult school on that property and so you know just for future planning in years to come maybe another Bond and move the adult school and take a look at what that property can do for not only for our community but for our our teachers and and our um our support staff in terms of affordability of of how so I just I just found it really interesting that's what I have this week all right thank you um next we have 13.2 California math conference Northern California math conference this is an update come on up Kevin and you can go

058ahead and introduce yourself and tell us where you work and tell us where you've been my name is Kevin Harrison I am a math teacher at uh bente very behind us front of you um I want to start off with saying a huge thank you to you uh for supporting me I went last weekend to a sar for the California math Council North conference where a bunch of teachers about few hundred Math teachers got together and talked about how to make math more engaging more learnable more understandable for the children um there were three of my top there several sessions three of my top favorites were at udl there was one session on udl Universal Design for Learning which uh gave me ideas of how to use manipulatives to make number sense more easily accessible

059for the students there was one about error analysis called decide and defend where you give the students U several worked out equations some are right some are wrong and they've got to decide if this is right or if this is wrong and then they've got to defend it so it uses their their Math logic to thinking and then another one was called AFL ask first teach later where you guide them to you showed them a partially filled in equation and you guide them through to doing the proper steps to get that done correctly all the way um those were three of my favorites other ones included one on Equity actually there were a couple Keynotes on Equity that I really enjoyed there were several on assessments how to use them how to design them and

060how to use them to guide instruction and there was a great one I went to on financial literacy which gave me some resources I teach financial literacy course as well um what I plan to do with this U because this is primarily was a math conference however a lot of these strategies I can translate to work cross-curricular and so I'm going to share them with my crew at bionis at bente as well as with the teachers at bionis what questions do you have thank you for for coming I do have a question so yeah I part of my other life I I also teach um uh construction management at city college and one of the things I I encountered with some of the students in Community College was uh as it relates to mathematics is

061um their inability or challenge with dimensional analysis right I'm kind of curious as to how much the the seminar or your courses dive into dimensional analysis as it relates to Everyday living great question um in this one in particular I did not attend any sessions that did that I do have tools though from another from Julia Robinson does some great dimensional analysis and some great 3D planning and taking view at what angle you're looking at to help you so there are tools to help with that yes thank you Kevin and thanks for your patience as we got here to we didn't even we didn't have students this week because we knew the organization of the board the reorganization was going to take a while and you were very patient so thank you very much and

062thank you for coming and sharing that with us yes thank you so much good night good night all right 14 is board member reports so Helen kind of started us off on this but all six of us attended the California School Board Association conference last week was that just last week a week and a half ago um in San Francisco so I will I'll just go down the road in a don't down the road guys really feel like I have to apologize to anyone who's watching this on YouTube because it's just thing after thing I'm gonna just go down the row the line of us I'll start with Courtney so what we'll just share maybe one thing one session you went to one thing that you learned that was a good or benefit from So

063Courtney you want to start off yeah so Saturday morning the keynote speaker was Mark Perna and he is a generational expert which I didn't really know was a thing but um he he was really fascinating he's written a book called answering why unleashing passion purpose and performance in younger generations and his talk was all about how um the current uh gen Z they're called um they respond differently and are motivated by very different things than um prior generations and so he talked about how that translates to education and so much of it was about that they really need to have a human connection and so much of Education these days is more about um just tactical and procedural and those types of things and that's why it's really not connecting with a lot of kids

064so he talked about things we can do differently um and he had some really great couch phrases um you have to spark the flame not fill the vessel um and then he said younger people they really are looking for mutual respect but they they want to see that they're respected before they will give respect back so he talked about things like um they really want to know do you see me do you hear me and do I matter to you so I thought those were really valuable things that would really probably help all of us and all of our um day-to-day our jobs our our in our family relations as well great thank you yes me so I attended um a few workshops um but the ones that I attended the the the things that

065stuck most to me was um when uh the experts in the field stated um that students student learning is directly tied to AC to academic success engagement and connectedness so if we want our students to achieve um they need to be happy we need them to connect to school in some way um they stated that in order for us to ensure that our kids are learning what they're supposed to be learning that we need to create an envir M at school that when the parent leaves the child at the school and they pick them up at the end of the day the child needs to leave better than when the parent dropped them off um I thought that was profound because it it's so common sense right but we get so boggled down with uh

066standards and testing and requirements and and then they also talked about about how um Jesus I just I might have just like um they they spoke oh that we need to teach to the whole child um and apparently right now the state has so many academic standards that it would take 22 grades for us to teach every single standard that is required by the state of California and they emphasized that in order for us to be successful and teach kids how they need to be taught we need to get together with the teachers and reduce those standards to 10 to 12 key standards that we can all agree on and teach those 10 to 12 standards to the max because right now we're trying to teach 22 standards and we just touching the surface we're

067not really getting in depth and they also said something that was like oh that's interesting if we did not do standardized testing there would be no sanctions upon us so it's a requirement but nothing would really happen to us if we did away with standardized testing and taught to the whole child so I thought that was interesting because they stated that we need to get away from standardized testing and emphasize teaching to the whole child in order for us to do the job that we really need to do in public education and that was really deep for me because you know when you administer a standardized test to a child every child's not going to do great on it everybody learns differently so I think that if we shift the way we think and teach

068to the whole child and mold that around having children be happy and connected and engaged at school I think we'll have different results than what we're getting now that's what I took away from the conference right thanks it's very interesting yes thank you for sharing that good um so I actually and there's a couple that I um attended but one of them that I found the most interesting was um collaborative effort to engage Youth and Community Partners in responding to the fentanyl crisis and I think um you know I don't think it's really a I don't see it I don't hear so much of it being a problem but when I um listen to this seminar it it really is very prevalent and um so it was a San Diego um district attorney that actually

069made the presentation and one of the things they're doing which um I was telling Helen about and she said we're going to do that too in January um where they actually invite um parents and students um for a seminar and they talk about Fentanyl and and so one of the things after after Co some kids maybe um had were stressed out or wanted medication and maybe had medication before covid and then they didn't have access to um you know maybe mental health medication and so they would order drugs on online and it would not be you know it was just from anybody and it would look just like regular um medication like aspirin or whatever um but it was laced with fentanyl and um they're saying that they had quite a few deaths from it

070um and you could cut the pill in half and one person would die and one person wouldn't because it wasn't made um effectively and so they had the seminar and they said you know even so it's really just educating kids and parents and I guess a new law passed where um they're going to give everybody who goes who attends some kind of medication do you know what it's called H um that they can give you that even if you administer it um you're not going to be held viable for it so I just thought that was really enlightening and I guess they were saying too that people are getting marijuana and marijuana is laced with fentanyl and so it's really kids need to know that um you know a shouldn't be doing this but if

071you order it online and you do these things you know it's like taking a gun and you know taking your chances you know pulling the trigger so it was just really interesting um educational and and scary to think that you know California is has so many fentanyl cases and I know I've heard it from other people too um and I think we're relatively Lucky in our School District but you know if just one death from that were to happen that's you know terrible so I think this class or the seminar that's going to be coming out in January I think Helen was saying um they're just trying to figure out a date and time um it's just so it's really inspiring and I think a lot of the parents and students will get a lot

072out of it so I really enjoyed that um it was it was very you know sad and shocking but at the same time I thought there was good information and it's nice to see that people are um focusing on it so that was mine uh a couple things um one of them that's uh kind of relevant and plant to with the discussions that's going on right now with our district is regarding funding and this a comment was made uh during the opening session of the keynote speaker or one of the the um speakers before the keynote speaker uh talking about funding and I would Advocate you know all of our our constituents Citi citizens teachers Administration uh to to um address their state representatives as a lot of our funding is directly uh directly impacted

073by the decisions made at the state level so I think it is a a key takeaway that you know what the negotiations and challenges that we're facing here as discussed in the U in the special session um are are directly impacted by our state representative so uh those those calls and letters and emails should be directed and sent not only to the local local board but also the state administrator state state representatives for the area but the other one that was um I one of the sessions that I went to I was really just impressed with the amount of people and the amount of effort and uh the the dedicated folks to our students of California and the number of people present at the conference um and one of the presentations that I went to

074um was from somewhat locally in the Bay Area the Cabrio Unified School District and um I'll call it a green initiative or as they call it the Su sustainability um that when I sat in and and looked at their their approach to this uh was not just a campus campus specific but districtwide sustainability initiative that focused on um the sustainable efforts at each site in addition or complemented with the curriculum that they're offering in the in the classroom and then by extension the impact it has on the community and culture um in the way of of job creation job awareness and CTE Pathways and what I found interesting was how much of these initiatives and efforts we already have in place um in in our district um whether it be the solar panels at all

075the different sites or the the separated uh trash at all the sites and the new Leaf uh education that we have at many of the sites and it seems like we have a lot of the parts and pieces to mirror what this district has done and gotten additional funding and a new CTE um but we can kind of um it's going to be kind of part of my one of the reasons the Committees I was joining was to kind of help streamline focus and uh redirect our efforts or or you know kind of uh capture all of our efforts and make it fruitful for our funding sources and like I said going back to the campus curriculum and and the community culture so uh it was a good good uh good presentation on sustainability and

076U and actually related or related to my Ace mentor in the construction uh efforts they they had created a dedicated Pathway to aggr science that was supported by their local FFA uh culture community and kind like I said created a new uh CTE pathway uh for their District so I think it'd be beneficial or something try to mirror at ours nice that sounds great um so I went to also a lot of sessions um but one that I I really liked was about Community efforts in involving people in educating them about what happens in board meetings so we don't always have a ton of people here but we do often get a lot of people when something of great Community interest is happening and in those times there's often a lot of confusion as to

077sort of the procedures about how a board meeting is run and so this um School District they were talking about some of the ways they've worked to welcome people into the boardroom and help them be maybe a little less intimidated about making a public comment help them understand what's about to happen and so this particular district has like a fact sheet that's just you know like at the back of our table where we have the public comment cards that be like some frequently asked questions like why won't the board respond to my public comment or um you know when when are they voting and when are they discussing something and when is it appropriate to make a public comment and how do I know if I should make a public comment under public comment or

078under the agenda item and all of these things that it really made I think a good point because we are just going through this and we're so used to the procedures that when you think about especially when we have students come in how much effort that takes for them and how much courage that takes for them and I think it it would be nice if we had some way to sort of let them know why things are the way that they are and that we're not really just trying to be up here and you know coldly ignore them or act like they haven't even spoken um and so I really liked that they had lots of different ideas the fact sheet they had another idea of putting slides up while the board is in closed

079session that's sort of celebrating different things that have happened around the district maybe even educating people on something that's going to be on the agenda that evening so that people are kind of aware and I just I thought that that was really nice and I thought about that coming from the lens of maybe someone who's never walked in here before and doesn't know what to expect that there are probably a lot of ways that we can easy ways that we can make them feel more welcomed and and to sort of understand them the process um and with that note I'm going to read this public comments thing and they were even saying you probably read something about public comments every week and you're just going through it and it's not really it's the if someone's

080never been here they're not necessarily getting all of that and so it's sort of nice to have it in like common language just this is what to expect so that the first time they understand is not when that three minute timer is going off right in the middle of their sentence so um anyway I will um definitely share those ideas I kind of shared them a little bit but I'll share those with superintendent Rossy and then with our new board president um Courtney when she is feeling better um but I thought that was a really great session so with that here we are with the big public comments thing under government code 549-5433 will be allowed 3 minutes to address the board 20 minutes have been allocated for this portion of the agenda additional time

081is allowed at the end of the meeting if there was not enough time to speak during public comments do we have any public comments all right I get exra 30 seconds Craig go ahead okay thank you Craig laer ready uh I wanted to formally uh thank the board and the district for the recent mou with Sandy Hook promise uh wanted to come and do that formally since I didn't make any time last time uh this the Sandy H hope promise program means a lot to me um I was involved in the district as a parent uh when was first launched in U 2018 and um I want to acknowledge our former superintendent CJ cam who really took the lead on getting that program going here and it's great to hear five years later uh what

082a difference that program has made in terms of promoting uh student and school safety and um you know sadly we know that in on Thursday this week will be the 11th anniversary of the Sandy Hook Mass occurrence hard to think that those young six year olds and seven year olds would have been high school seniors this year it's hard thing to grasp and you know when these things happen we all move on with our lives after the shock wears off but uh those families never get to move on um but I got a chance to see Nicole hawkley the founder of Sandy Hook promis or one of the co-founders talk at the County Board of Education in Pleasant Hill when this program was first being launched here in our County and um make [Music] um

083so really is about safety and safety um is a core requirement for kids to to prosper and Thrive academically emotionally that's a starting point and um you know and it takes many forms and I think it really goes to the issue of values and what you know sometimes we we confuse political beliefs with values political values in terms of uh what we're trying to accomplish for students and what we those should be our priorities and values are core values are fundamental um you know the idea that we should have a real Reckoning over issues of race and we should acknowledge the the facts around systemic racism and the legacy of racism how that affects people today that's not a matter of a different political belief it's matter of a value whether people have the the

084core value and goal of wanting to reach the same place you could have different beliefs on how to get there and I've changed my beliefs on how to get from point A to point B at times um but you know when we hear about the lgbtq community and what the students uh had to say um during that issue last year um that goes to values safety making them feel safe making all our students feel safe so thank you again for your work on Sandy of Promise thank you are there any other public comments okay see none we'll move to 16 which is our consent calendar approval of the consent calendar means that all items listed here under are adopted by a single motion unless a member of the board or the Stu superintendent request that

085any such item be removed from the consent calendar and and voted upon separately are there any changes to the consent calendar there are none okay are there any public comments okay board discussion just one before sorry one just recognition of the donations and gifts but one kind of speaks to one of the programs at the high school is the the vehicle and the success what great success the automotive program has had so recognizing the um the donation of the the Volvo to the program all right very nice that was it sorry no fine I was going to make a motion to approve the consent calendar I'll second all right marel I Courtney hi and Courtney I want you to know that every time I've called your name I have looked at Joe's computer next to

086his screen you are there is Jasmine hi Tanya hi Carlos I I motion carries all right 17 are discussion items and we have just one tonight this is mtss mental health counselor job description update presented by Dr scero so MBA and uh the Martinez Unified School District work collaboratively to update the mtss mental health counselor job description so it was align with the current language in the meusd contract specifically article 11.17 uh the board is being asked to review the updated mental health counsel job description and I'd be glad to answer any questions if there are any okay public comments I'll bring it back for Action at the next board meeting okay perfect we will see it then so we moved swiftly for a while but I think that we're going to get a Slowdown

087here so 18 that's okay it gives us a chance to not talk for a little can I make a motion take a five minute break since it's eight o'clock um or because I think that's gonna take a while when we what I think we should do instead of since we don't have any audience well we have one audience member um if anyone needs to take a break let's just do that without taking a motion I think it's fine if we're just you know two three minutes and then that way we don't have to make the public wait again too and stop but yeah I actually meant to bring that up several months ago that we could just do it that way but I forgot so thank you uh okay so 18.1 first interim report and

088this is presented by Andy camon I'm gonna take that sticky note off my back that says pick on the CBO um and with that I'll start first interim Joe is this working the device to move back forth good Perfect all right so uh board trustees good evening and thank you for the warm welcome to the first interim report um tonight you're are here to see the 2023 24 first inter report for Martinez unified um Ed code 42130 requires school districts to submit interim reports each year showing our revenue and updating our expenditures through the end of October and then we compare it to our budget that we passed in June um it's an opportunity for staff the board and the community to see our Financial Health progress and allow staff um to ensure that we

089will meet our financial obligations so there are three main purposes for the first inim report um again it's going to show our actual data from July 1st of 2023 all the way through October 31st it's going to project our revenue and our expenditures for the entire fiscal year um it does highlight changes from the adopted budget and that was approved in June and at the end of this we'll be able to declare if we are able to meet our financial obligations for the current and the two subsequent school years this report is based on assumptions our overall budget we do not get money UPF front and so we have to factor in a bunch of different categories to figure out what our Revenue is going to be and so the chart in front of you

090shows those assumptions the first of which is enrollment you'll notice that um our enrollment over the next two years is going to be less than this year so next year we're projecting about 78 um student decrease and Then followed by the 25 26 year we'll actually see a small uptick in students so we're starting to finally see the end of declining enrollment um but we still have some issues with adaa that we're going to get into our 8A percentage when we met in June we had this 8A percentage at 93.5 since that time we've seen some growth in our attendance we're starting to get back towards pre-pandemic attendance percentages and because of this we were able to increase this from 93.5 to 94.5 but at the same time our funded Ada is still much more

091than our actual Ada and we're going to talk a little bit about this in the upcoming slides what that means for us is that we are funded based on a three-year average so our actual Ada of kids coming to school on the daily basis is still less than what money we're getting for um and this year it's about 135 dis difference you're going to see that it's going to flatten out um somewhat in 2526 and it'll be almost flat in 2627 which isn't shown here our unduplicated pupil percentage is 1,178 and we project that to slowly decline um next year and then flatten out Cola is represented as the cost of living adjustment from the state we are projected to have an 8.22% cola this year um mind you that that Cola 8.22% part of

092that was funded based on the state using onetime funds they already gave us so in Martinez's world we had about $480,000 that we have to give back to the state from restricted funds in order to help pay for that 8.22% Cola as we look towards next next year um currently um we are projected to have a 3.94% cola but we'll talk about it in more detail um Financial analysts right now are projecting that a cola is probably going to be closer to 1% and that's going to be significant um and they have not updated the 2526 those updates are going to come in January when the governor presents his um his January budget proposed budget local Cola I'm not going to go into it yet because I'm going to explain what that is it's a

093somewhat contr controversial um term and I'll explain why we use local Cola and what the benefit of looking at that perspective is going to be uh inflation is starting to cool but it's still high we see 3.55% of the CPI and it gets down to three and to 2.6 in the next couple of years our stirs rates which is our pension for our teachers is flat it stayed at 19.1 but we do notice an increase in purs from 26.7 to 28.3 over the next couple of years and we just recently received more notification um in the next three or four years after that that there's going to be a steady um but small increase in Pur so that's something that we're going to have to account for in the next few years Health and Welfare

094you'll see a real initial um increase of 133% this year and that's going to be taking place in January um and that is predicated on Kaiser increasing their rates by that amount most of our um staff who participate with Health and Welfare do take Kaiser either family two-party or single this chart is new you haven't seen it before at least in an interim report um but I wanted to start exploring in Greater detail the concept of funded Ada versus actual Ada um so again the state does not fund districts on their enrollment account they funded on average daily attendance so you can have 10,000 kids in enrolled but only if 200 show up on a daily basis you're receiving the funding for the 200 kids so it's really important that um all school districts especially

095ours are promoting that kids come to school every single day we Supply the state with our attendance data twice a year we refer to that as P1 and P2 so P1 we submit documentation in January which we are working on right now and then P2 is in April uh so for Budget purposes we project Ada each year and then we base our revenue on that factor so we take what um our lcff calculator and the state says we should get per student and then we multiply it by our Ada in this case we use funded Ada and our funded Ada um is our three-year average so if you look at the chart for 2022-23 last year you'll see that we had a funded Ada of 3867 and we had an actual Ada of 354 so

096let's just do roughly $1,000 last year per kid to $112,000 per kid you multiply that times the difference between 3500 and 3800 so 3 53 kids that times at 11,000 that's how much more money we got because of the state allowed us to use a three-year average than if we just use our actual Ada so we are overfunded um for lcff based on this um scenario which is a great benefit for the district but you'll notice that blue line has a slowly descending curve and that's because each year as we have declining Ada and declining enrollment we are seeing that we are having a drop in our funding the brownish colored line represents our actual Ada and that actual Ada is going to have a nice little spike in 23 24 that's because we went

097from 93.5% attendance rate up to 94.5 because of how we're trending but you'll notice that we'll come back down before we get really close to have an actual Ada and funded Ada meet and that's going to be in 2026 27 now these are projections we could have housing communities develop we can have lots of folks move into town or we could have folks move out of town and these projections would change but right now at this moment of time this is what we're looking at so if we look at this year and that's where we having those assumptions the difference between our funded Ada and our actual Ada is 135 students just for a reference point 135 students is about five teachers FTE and at about $130,000 total compensation this is about $650,000 more than

098than we would have if it was just on actual Ada so when we talk about Cola and we're going to see this in the next few slides Cola is 8.22% of the funded Ada so when you see that our funded a decreas Down Below even though we're going to see this Spike right we go from 3514 and actual 88 to that's our actual Ada but we're not getting funding on an increased number of ADA kids we're actually getting 8.2% on the decrease from those two years in the blue and I'll and I'll show this it'll be a little easier to see in the next couple of slides um Revenue sources for lcff and this is where we're going to show that we only see a 0.1% decrease or excuse me yes decrease our lcff from

099adopted budget so we're largely staying flat there for next year our federal revenues are increasing by 3% but this is mostly from our one-time Esser funding Esser 3 funding that is being carried over so unspent funds carry over to the next year um other state revenue we see quite a big um increase we see about 1 point million 1.1 million of increase this is from two different sources we see prop 28 which is our Arts and Music school funding this was the voter approved 1% increase to the education budget so we finally received that dollar amount the state legislature was taking a long time on determining what are the parameters of that and then also sending out the allocation amounts ultimately they didn't really give us much clarification um if you still look at their

100FAQs on the website they say Seek legal councel for more information on how to use the funds um so we will navigate through that um this year and next year um we also saw a transportation reimbursement so at the time that we passed the June budget we knew that we were going to get Transportation dollars but it wasn't known quite yet what it was because we were preparing the budget in May for June adoption we didn't receive our first or the 2022 23 Transportation reimbursement until middle of June and then we knew what our this year's budget was too so those putting all together shows that we had an increase of 1.1 other local Revenue increased by about $700,000 this is from a one-time solar um reimbursement um our solar panels did not produce at

101the level that our providers said that they would and because such they had to give us the difference between what they said they would produce so we had a one-time reimbursement for that um other local Revenue includes some tuition from other leas for sped and also site donations so in total our revenue from adopted budget in June to this time first interim shows an increase of 3% okay getting back to Cola and how it um relates to our unrestricted lcff um I wanted to put another visual in place and the idea that that we're looking at is trying to show that just because there is a high Cola of 82.22% and Then followed by a four and a 3 .29 does not necessarily mean that we received that proportionate amount of Revenue in lcff again

102that's because we're seeing that our funded Ada is being lowered by that three-year average Trend so if you look at the chart from um in 2022 23 we saw 5.4 million increase based on that 133% um Cola in 2324 we're seeing a 1.35 million increase and that's based on an 8 .2% in 2425 we are only seeing a $2,000 increase even though there's a almost a 4% Cola there that is again because as we lose our funded Ada the cola is only on the new amount it's not on the previous so when you decline you have less kids attending school that percentage is based on your new Ada amount for that year in 2526 we see only a $320,000 increase and mind you we haven't even calculated the fact that in 2425 it's being projected

103that we will see a 1% Cola um and that is because the state is looking at a$ 26 billion um loss in tax revenues based on what just came out in October and so they're gonna have to find a way to uh pay for all these things now the legislative analyst office that came through with that figure and is been promoting the idea that we might only see a 1% Cola they said that there are a couple of different ways that that the state can address that if they wanted to try to get to that Cola they could take back restricted dollars that they've already given us or they could possibly look at um accessing the rainy day fund where we've putting put away um billions of dollars for Education over the last few years

104so we'll see again what happens in the January budget proposal there but if that 1% Cola word become true we would see a million dollars loss in 2425 that would mean we would have a negative local Cola for that year and I'll describe what that is here just shortly so I know that the concept of local Cola and how Ada is calculated can be a little bit difficult for people who don't work with it on a daily basis so I've coming up with a scenario that I wanted to explore with the board and for the public to hopefully help kind of illuminate how things work how you can have a large Cola and still have less Revenue the next year or even see a decline in Revenue so in front of you you see a

105visual and I painted year one this is a purely hypothetical situation so in year one if the district had 20 students and they received $100 per every student they would have a $2,000 Revenue in year two if they had an ADA loss of two students they still had $100 per student the cola was 10% so what that means is instead of getting just $100 per student you would get $110 per student you take 18 students multiply it by $110 a student which is the base plus the cola and you would have a revenue of $1,980 what that would mean is you would have a local Cola uh or a decrease in Revenue overall of 1% so this is kind of a polar example but I wanted to see that even though in this case you

106had a 10% Cola but because you had less student Ada you actually had negative Revenue growth and to some degree that's what we could be facing in the next two years depending on what that Cola comes out to be so an 8.22% Cola in reality for us is a 3% % local Cola or a 3% gain in lcff revenue from last year that concept of local Cola is is relatively new from a language and semantic standpoint it's not new in the sense that how much more money you got from the previous year by a percentage but the term local Cola is something that we're trying to use to explain our current financial situation and really speak to how that we didn't receive an extra eight percent of Revenue because sometimes people look at Cola and

107they think that Cola is the percentage of Revenue increase Cola is applied to your Ada your Ada then determines how much your revenue is now you subtract those two Revenue points from the previous year to this year to get you to there as we look at expenditures um expenditures are projected to increase by 1.7 million million doll compared to what the June budget was so not only are we looking at Revenue that is is struggling with a local Cola of 3% Cola of 88.2% but we see that our costs have gone up um specifically if you look through here um CL certificated salaries were up by almost 2% classified salaries did drop by 8% that's significant but it's significant because at the time of the June budget we anticipated that we could fill all of

108our vacant classified positions um that has not occurred and because it has not occurred we've had to shift the budget from classified salaries into our contracted Services because we are having to use contractors for um par Educators for speech language pathologist um for psychologist and other positions that are mostly in the special education realm that are high needs and um low availability out there in the marketplace um books and supplies um have decreased by 3.6% our largest um and by far largest is services and contracted so again that's we're Contracting sped positions out of that um we're also having increased services for sped students so our MPS our transportation and our County um education tuition amounts have increased and uh a good thing but it doesn't necessarily look here um our after school program we

109have increased our service and so instead of I think last year we had about a $600,000 contract with the vendor for after school programming we are now um I think we're at 400,000 now we're at about 1.6 million is that we're expected to use for um after school program um I use this visual in all of our presentations it's to get a sense of where the money goes via visual so you'll notice that the vast majority of our expenditures are for Staffing cost so that would be the gray the green and the blue and even part of the burgundy color services and contracts um a lot of that is for contracted services with staff again because of the special education situation um it includes 10 Paras six speech therapist and one psychologist fit within that

110um so we're looking at or in the neighborhood of 80% of our expenditures are on Staffing when we look at our multi-year projection um we are required to look over the current year and the next two years and ultimately we have to determine whether or not we will meet our um our interim Reserve amount of a minimum of 3% so as we go through here um what's not listed is the previous year from 2223 but we will see a decline of about $5.8 million or we currently are seeing a decline of $5.8 million of one-time funds this is mostly um money from last year that was our restricted funds which we talked at length about in our special session um earlier um it is because of enrollment declines it's also because of onetime funds and

111you'll notice that in here it shows that we're deficit spending for this year and for the next two years so this year we have almost $2 million deficit spending next year it'll be almost three and the following year almost $2 million um and that is a problem when you continue to spend down your reserves we are able to meet our 3% um but there will be a time when we can no longer do deficit spending um and again that was part of our earlier work study session our beginning balance U went from 13 million to eight and if you notice our ending balance is down to $6 million in 2526 that means that we will be burning through more than half of our Reserve in the next two years beyond our fund1 we do have

112several other funds and they're all listed here in this graphic um fund eight is our student account fund fund 11 is adult education fund 13 is for our cafeteria um we continue to show a great profit there um last year we went ahead and increased our food cost um and that's proven to be really good so we're providing more scratchmade meals to our kids and if our um ending balance continues to hold like this that we can explore adding more dollars to the meal um process and to get even better quality mood food for our children um fund 20 is for our post employee beneits these are our retirees um who we continue to pay um Health and Welfare for um our next ones 21 25 and 35 are all about facilities um we are

113um approaching using all of our measure K and measure R dollars um as we conclude the projects John sweat and head on to morela park um fund 35 we talked earlier tonight about the facility meeting we will have a couple facility meetings um in the new year to start talking about how we're going to spend down um those dollars on needed projects throughout the district um fund 40 fund 51 and donations fund 73 of $258,000 are all listed there so what do we ultimately have to do um we have to certify that we'll be able to meet our financial obligations for the current and the two subsequent fiscal years and I am reporting that we do have and can um say that we are projecting a positive certification for this budget report um looking ahead

114um we do have some difficult decisions as a district and the board does in looking at our Financial Health um we have multiple challenges um covid-19 from the state and federal government is expiring our attendance relief measures our three-year average is is steadily diminishing and we've already talked about how the economic forecasters are saying that we're looking at a 1% Cola next year um in addition um we have done some really great things in this District over the last couple of years we have increased employee salaries by 19% 9% last year and 10% two years ago and currently we have tendered a 4% total compensation offer to mea that includes 3% salary and a built-in 1% Health and Welfare because of the increased cost of Kaiser and other medical packages um these factors will require

115us as a district to make some substantial reductions in Staffing books and supplies and contracted services so that we can meet that adequate financial reserve of 3% and right now we have not included in this um this report the possible Revenue drop in the next few years so if that is to take place then we may have to go deeper than what we even prescribed earlier today in that budget reduction worksheet looking ahead um we do have fiscal reports coming up so first interim that's today in December in March we will have our second interim that'll give us a chance to take the Governor's budget apply it and to be able to present um new report it'll give an update on our revenues and our expenditures and what we're projected to do by the end

116of the year as we progress through the spring it will be here before you know it in June We'll be asking the board to adopt a budget for next year followed by a 45-day revise if needed and un audited actuals in September and I appreciate your patience with me that's a lot of numbers and a lot of details I'm available for any questions you may have about the first interim report Andy can you go to the um the expenditure slide my question was um there is quite a big increase in the adopted budget versus the first interm for the services and contracts can you speak a little bit more about that yeah let me grab that slide for my notes so you're looking at the 33% increase in services and contracts yeah um I think

117the easiest one to look at first is the after school program contract um so that is um about $1.6 million increase there um so overall we're looking at 2.8 so that takes off more than half of that the other is the increase in um contracted positions through special education so I think just with our slps our speech language pathologist that contract alone is I think a million dollars for the year and what we're struggling with is the shortage of specialized special education Staffing I believe that they're seeing that they can make greater compensation and have more flexibility by working with a contractor firm then they can by applying for and working within the school district um so it comes down to compensation and because there's such a a shortage of that we're kind of stuck

118as many school districts are um and just to give you an example today I got an email um for someone wanting to work as a speech language pathologist but they're working for a contractor they gave me their resume all their information and I joked with Janelle and others I said well I wanted to reply to them here's our opening on Ed joint apply there um but it wouldn't have made much good because ultimately they're finding that for whatever the contractor is providing it is more beneficial than taking the job through the traditional way of coming to work for our district um and that's not just us that's across the bay area and probably even further um as we meet with um selpa and other groups we all have the same in conversations like well who

119are you using for your contracted services and if anybody has people in these positions it's generally because they've been around for a while and they're just loyal to the district and comfortable um but I I I believe that anytime we go to a hiring Affair um or you know uh any type of event where we may be hiring and looking at these positions um District administrators Chase around candidates that are in special education trying their best to convince them to come to their District so I think it just speaks to our cost increase for that specifically is speaking to just our current situation with hiring and shortages in special education um the other part of it is we're just seeing a lot of cost our MPS cost are going up um one student could cost

120a couple hundred thousand dollars just depending on placement and for right now uh we think we're as lean as we can be with special education um we don't see that our costs are going to go down by any means we're hoping that our cost won't increase by too much as we move forward with the rest of the year it's surprising that I mean I I can understand how maybe a private contractor could pay a higher salary but there are so many other benefits that come here like the the educ you know the wealth the uh Health the the purs um I I wonder if that's just I'm just putting a pin in it for a later conversation of um other things that maybe when we when we do talk to our our state legislators what

121there you know what maybe they can do to help us with that type of issue what about the increase with the um with the after school program is there anything we can do there no that is a those funds are given to us by the state and they reserve for that so this isn't affecting our our unrestricted budget um these are actually only can be used for after school programming so it's actually really supportive that we did this what happened in the past is the state gave us the money but many districts were still dealing with the pandemic getting kids back to school and they wanted to have kids stay for nine hours a day so you dealing with some um some challenges of just implementation and I think it's just taken time so we've

122been able to roll over the funds over the last couple of years last year was our first year to implement the program and we wanted to get it started and get it rolling um before uh director espanosa came on board um director Lopez and I worked on where we would put those positions and how we would expand it so this was a known thing that was going to happen eventually it just didn't get included in our budget at the time okay thank you on this slide I had another question but unless I missed it I think you might have skipped over the difference in the benefits the change in the benefits yeah the increase in benefits um we over projected um what that um salary or excuse me the benefit increase would be because we

123only knew it as a as a guess as we got through and we have actual employees and actual work we recalculated that and we found that we could save some funds and the idea was we're trying to really trying to look throughout our budget and superintendent Rossy and I have gone up and down so many different times in this budget trying to make sure that there is no extra amounts anywhere in here because we wanted to be really authentic to the process of saying this is what we have available to work with okay it's also um excuse me reduced so when we build a budget and we have a vacancy we add in the salary and uh benefits and then as they flip over to contractor there's no more budget in there for benefits correct

124right we take that out from the classified who were so all of the the um the syes and the speech and language that we weren't able to hire um I think we have all of our teachers it's just Sykes and and yeah I think I said it was 10 Paras it wasas six speech therapists and one psych right not all the six speech therapists are contracted I think it's 4.6 of them are right so it comes from there okay and then I think my my only other question I think is just easy clarification on the slide the multi-year projections do these the reserve for the second year for the each year out does that include any salary proposals that we have made or any potential salary increases at this point no I presented the salary

125increases at the work study as a way to just kind of project it out but at first interim because nothing is settled these do not include any of the offers um to mea or any other bargaining unit okay so obviously any any salary increase will decrease those reserves that's correct the first inum is a snapshot all the way through October 31st I wanted to piggy back off Courtney's questions the first one um about the after school program do we know um what percentage of students that are attending our lower income needy students versus students that whose parents could actually pay for the program if we weren't giving it to them for free I'm gonna defer to director Espinosa uh I do I don't have those numbers for you but I will let you know that

126we offer it out to those students first and so so they have priority enrollment in the after school program as well as we hold some openings um if in case we get enrollment throughout the year but if you would like the exact percentage I can get that percentage for you so I had heard that there was some confusion because apparently last year there was an email that went an interest email that went out asking if you were interested in enrolling your child in that but apparently there was a second step you had to do to actually get your child in the program and some parents who are probably lower income missed that second step so that was just a concern to me like are did we allow children whose parents knew how to follow the

127procedure into the program versus parents who probably didn't know that there was a second step they had to take and to answer that that answer would be no we did not allow that we did hold space open and we did do followup um with parents individually to ensure that they understood the process so if there was a need then the child was given given a spot okay thank you and then as far as the uh special ed people coming in through the contractors um there was a TED Talk that I heard that um I think Helen before had mentioned that when people apply into our district we will automatically reject certain applications if they've already applied or if there's some key words or stuff that happens in there and no we don't automatically reject anyone

128we look at each and every application that comes in and we look for maybe someone who has applied 16 times to the same job and we've interviewed them two or three times we may not choose to interview them again um that's up to HR and the administrator in charge but we don't just automatically reject anyone we look at every single application that comes okay because I had heard through TED Talks that there were keywords that you had to use so maybe it's easier for certain people to get in through a contractor versus trying to dig in through the system which may not be as easy to get through just throwing that out there anyone else have any questions for Andy okay we I have good questions oh you did I thought you said I shaking

129your head I was giving the chance for okay um Andy thank you for for the presentation it was it's very um very well put together and very uh explains the especially the uh the local Cola matter um at the conference there was I did attend one of the sessions that was uh facilitated by csba and the is it Loa La Lao La thank you and it was literally kind of hot off the press the forecast for the for the deduct in the state budget I think they said it 1.6 52 million I've read now maybe as much as 68 sorry billion um and so in in in the discussion and the Q&A with the representative um one of the things that was thrown out that's or is a potential alternative for the state to make

130up that deficit is midyear reductions mid cuts um so all of this could be for not right it could be out the window based on what the what the state does so I guess my first question is um do you have experience or Helen superintendent Rossy do you have experience of what that would look like uh have they pulled that that that action before and what do we have any history I can I can speak a little bit to deferrals um so one aspect they can do is they can do deferrals and what they say is that we owe you money in January and we owe you money in February but we're not going to pay you till March and so they will delay for two or three months those fundings you'll eventually get it

131but you may not get it in the time you need so sometimes what happens is it'll cause um issues with your cash you have to be very careful that you have enough cash every month to meet payroll and sometimes you may have to borrow money in order to do that because the state may defer it most likely um what they're talking about with the state is that they will um change our apportionment so what they did for this current year is when we had the uh Arts music instruction materials block grant they said you're going to pay us back so many thousands of dollars so normally we would give you you know $2 million in October we're going to give you $2 million minus what we want to reclaim back from the restricted funds and

132so they can do it that way as well um so we just don't know I haven't heard that they're going to try to do anything this year I think that might be just the scary news that's coming out there because they wouldn't be able to even share that information realistically with us until January at the governor's proposal and then there's a lot of other steps that go with it um but I I don't know for sure um but if we did that um they would have to communicate to us we would have to adjust our budget accordingly and that would cause um a great impact to us depending on how much they were going to pull back mid year we would we would find out in January at the governor's budget but I had heard

133the same too that they were going to pull back some of the um money the restricted the restricted money that they gave us that they already pulled some back on that they were going to pull more on but we won't know anything until um January so we just sit tight and wait for the next Hill on the roller coaster so I have a couple other questions that follow a question on your answer um if we are pushed to a position of having to borrow money or something like a line of credit of our own who's that set up through or what bank and what's the interest on that well uh one is we can do inter fund borrowing so we can borrow from other of our fund as long as we can pay it back

134by the end of the year so we do have cash reserves and other accounts that would help us for that um the other is you can go through the county office if they have enough funds then they can do um loans and then you can always do outside funding which um called trans right off the top of my name I cannot give you what that stands for um but you can borrow outside at a discounted rate but you have to pay that back within a within a year when covid hit and um the money there they started you know there's no money there's no money and they were they put us they made a schedule of deferments for over the course of a year I brought it to the board and um we had enough

135cash flow to cover us through but there were districts in the county that did not and they had already made appointments to to look at um borrowing money so we'll we'll know way ahead of time if we have to do that um going back to your the revenue slide um you have the lcf lcff the federal the other state other local are um how are these divided up or how what are the percentages that um that fall into restri red versus unrestricted um well for this year 80% of our revenue is in the unrestricted column and 20% is in the restricted column is that sprinkled throughout like with the different sources uh yes it is okay and any given year depending on what happens if the state has a a glut of money which they

136did have a couple of years ago then they may choose to Dole it out through restricted resources where they have a little bit more control and that's what happened the last couple of years so the 8020 wasn't true the last two years it's only true this year yeah and then my last question going back to your Cola and I again I appreciate your your example or um yeah your example of the local Cola question mark or the um process can you speak to and kind of I kind of understood it the same way the cola is for the district um but there is a school of thought that the cola is for the cost of living I.E to the limited to labor can you kind of speak to the I guess the precedent on how

137that was said or what the that argument well yeah I can um it it is if we as a district took our salaries our benefits in Health and Welfare and we put it all into one total it would really be beneficial if the state said we're going to take whatever that total dollar amount is and we're going to give you 8% more right that would be a very equal your your your wages cost plus 8% would truly be a cost of living adjustment but it doesn't look at it from the number of FTE you have it looks at it purely as um how many kids you have going to school and multiplying that times the average number of dollars per kid times that Cola so when you drop that's why you don't see an 8%

138if we were in a um an enrollment District that was increasing we could have an 8.22% Cola but our local Cola may be 10% 12% or 14% because of that increase of the number of students we're having that's because we are seeing more Revenue because we are getting a cola plus we're seeing increasing enrollment and that's what's really is a misnomer right so on one side if you had increasing enrollment people would not be asking for for the cola as a pass through they'd be asking for more than Cola what it means is that that Cola that 88.2% is not actual increase of salaries benefits there it's only proportionate to your Ada and that's where we get the scenario and confusion honestly about how much money does the district truly have and I can tell

139you from the financial reports that are here that are being submitted to the state is we don't see 8% of Revenue increase we're seeing only only a 3% increase in lcff Revenue thank you I didn't see any other comments from the board or questions we do have a public comment Craig come on it another [Laughter] battery [Music] e start i' I've been very interested in the the budget issue the last week or so given everything all the Scuttle butt in the community um but I when I look at the presentation and all the facts it strikes me that really uh the district is in a in a catch 22 kind of a vicious circle here when when it comes to funding in your budget looking to the Future because obviously funding depends in large part

140major part on enrollment in Ada and we're not growing Ada in enrollment because our population is falling in Martinez in the county and that's because the cost of living is too high and people are leaving as superintendent Rossy said a few weeks ago people moving families are moving out of state they can't afford to live here that's affecting our Revenue news um but as the cost of living gets worse we have to pay more to hire to recruit and retain uh the people we need to educate our children and that creates more pressures on uh salaries on compensation which makes the budget situation even worse now there's always a school of thought when these I've been following the budget discussions for years and years whenever this situation happens when dealing with a deficit and there's

141not enough money to to pay a living wage to teachers or what have you it all comes down to it's all the state's fault just go to Sacramento BR I'll beat them to give you more money well that's not going to happen because well we got a $68 billion doll deficit or whatever it is that's that's not going to happen I went to a town hall with a sem Grayson a few years ago n about school funding he just aditt to be fled out he had no idea how school funding works it's is still so damn complicated can't figure it out so what's the solution well a big solution is locally and it's housing right and Miss Ro superintendent Rossy referenced that and we need our community to get behind housing in a big way

142affordable housing that'll solve so many problems we build more affordable housing more families will be able to live here enrollment will go up Ada funding will go up and uh you'll be able to to pay your teachers more right and but we've made no progress there like a lot of cities because Nim ISM and nimi interests have had their way for too long now the parameters and framework is being established at the state level so that we could really make progress on this issue but it has to be a priority and there's going to be a housing element meeting at the city council on December 20th we need the community to get behind getting housing built in a big way if we don't do that the problem is not going to get fixed we can't

143force people to build houses we need to go find developers and do what needs to be done that's the solution to your budget problems thank you right thank you okay so this is an action item you need to pass this right or we need to vote on this so if there is no further board discussion we're ready for a motion I'll move to approve the first interim report second Mar I Courtney I yine I Tanya I Carlos I I motion carries thank you and thank you for answering all of our questions and hopefully I think it was presented in a way that was digestable and understandable so thank you so much 18.2 is adopted adoption of resolution 2024-the signatures resolution superintendent Rossy will present so with the reorganization that happens each year of the school

144board um so does the um authorization of signatures so as positions change we have to sign a new signature card and the resolution that is attached to that is the resolution and to stay at the end of the meeting to sign the document um or I'm going to be in trouble with Nikki because she's texted me emailed me and pretty much wrote it in my forehead please stay at the end of the meeting to sign um I'm asking the board to adopt this resolution for the um signatures for uh the 2024 school year or calendar year sorry any board discussion or questions you have to run to Courtney's house to get her signature yeah that I was just gonna ask that thanks Carlos you're gonna have to come in Courtney and meet with Nikki you

145have in you have to come in on Wednesday morning anyway to meet with me as the new president so okay so it does it if we do it by Wednesday then that's okay that's fine thank you okay I just don't want to get anybody sick but Wednesday should be okay I hope okay all right so so oh public comment on this one all right we'll take action on that you need a motion move to approve the adoption of resolution 202 24-10 second all right Marisol I Courtney i yasine i t hi caros hi hi motion carries 18.3 is the calendar committee recommendation presented by Dr sco so I presented the C committee recommendations at our last board meeting today we're just asking for the board to approve the 2425 2526 2627 school year calendars uh

146these calendars are all recommended to the board for approval by the musd calendar committee made up of parents mea CA and Mass representes for discussion or questions public comment well I'll go ahead and move to approve the calendar committee recommendation and I would also like to thank you because long time ago we had these calendars come out three years in advance and we sort of got away from that I think Co and a whole host of other things but I think it's really nice for our families to be able to prepare in advance so I think it's is great that we're back on track and thank you for your hard work on that so I'll move to approve second okay Marisol I Courtney i yasine i t i Carlos I I motion carries eight 18.4

147is approval of annual developer fee report and resolution number 20 24-11 and this is also present presented by Andy Canon I was waiting for any other comments no okay um so each year uh we are required to bring our developer fee report and uh and that's what we've done so what you see attached is actually the report itself and the resolution to approve the report um for everybody who's watching and for this board um we do um charge our community a cost per square footage depending on if they are constructing a residential building or if they are using a commercial building or constructing a commercial building on page four of exhibit a it actually goes into what those price amounts are um as you go into page five and section c you'll notice that um

148that we did begin with a balance of $640,000 and we ended with a balance of 186 we did spend money on projects so we put money towards both Morel Park and John SWAT because the idea is that as folks build houses or build these things that they are using the school facilities and that these dollars should go directly back into them so we were um looking at the best way to be responsible to what the fees charged were and where they were going to and so we applied it to those construction cost and so if you look in section D our expenditures we spent almost 700,00 um part of that was on a developer fee study we sent out Communications and then the two large projects at John sweat and laus actually um not um

149not morela park so what we're asking the board tonight is to approve this report in resolution 2024 lost my place here is 11 11 um but before that uh pass if you have any questions I'm happy to answer them I do have one question so you said we do spend this money back on our sites and construction projects are they strictly speaking are they restricted funds or are they I mean do we have to do it that I mean I get that that's what we're telling people we're doing and it's the right thing to do but just for clarification purposes yes they are restricted funds okay um so they're not allowed to go into our general funds and sit there we actually have to use them for these purposes and they stay in that fund

150got it thank you we have one one public comment so on the issue of developer fees this stailes with what I was saying earlier about housing and that is um I'm not sure if you're aware but a key element of um our own housing element of martinz that's going to be approved by the city council and something that's become more and more common um elsewhere is the idea of deferring developer fees um as a way to stimulate the development that has not been happening that we need to happen in order to grow our enrollment and grow our Ada funding so I don't know if that's something that's been thought of uh within the school district in terms of uh your developer fees that you charge obviously anytime you defer developer fees it comes with a

151cost but I think the narrative around the idea that development is a burden on school districts is really being flipped on its head now given the funding challenges um so that might just be something if I just want to throw out there um whether or not there might be incentives the school district can utilize to try to stimulate the type of home development particularly affordable home development low income home development type of homes that will allow you to hire teachers for you're starting out and need a place to live so just want to throw that out there thank you thank you okay any other board discussion or [Music] questions address Mr laz's point it's kind of a good question because we give significant discount for the development of senior housing um but it's a you

152know to develop a 2,000 square foot house it's going to cost $10,000 um and I don't know if there is an opportunity to incentivize development um for the kind of the people who be in the kind of houses that we we need well and then that presents an interesting aspect of it because how do you determine whether a household is going to have children that would attend the school that you would do that for right because if a Housing Development for example a senior housing development would not have any beneficial impact towards supporting schools necessarily not to say that that's wrong to do so but it wouldn't uh a housing community that featured three or four kids per you know per unit that would go to schools would have a dramatic impact and so I'm

153not sure just talking off the top you know how you would distinguish between those because once you start looking at reductions or waving those fees it would have to be specific to it um but you know directly I've never even thought about the concept of waving it or what that would mean for that production I think it's something that's interesting and that we can explore though well and the other part of other part to that is it's uh I guess important to note that half say half the district or a good good portion of the district isn't within City city limits and it's a a county issue of and and tracking the develop development outside the city limits but still within the district yeah we're able to collect on our attendance area right yes yeah

154which should be a good part of be unincorporated County so I believe that Dublin unified has had an increase in students and I think it's because of the high density housing that they've developed can we look into what they're doing as far as the school district in relationship to the housing that they're creating see if anything's going on with them that maybe we can mirror or look into I don't know that they're doing Workforce housing though the school district no they they are I know Dublin is the a lot of the development in the Dublin area is to support the Silicone Valley um demand just because it's it's a it's along the corridor so it's there's a geography associated with that but to your point point though it's worth exploring uh for the developer or

155we can look at it for developer fees is that what you're asking as me for developer or whatever else they may have in there that we don't know about if I could make a suggestion because this has come up several times throughout tonight as a theme housing in general you know what districts are doing Workforce housing maybe we want to have this as a future agenda item where Helen can talk about some of the things in more detail that she learned at the conference we could perhaps have a an a component about developer fees for the future how we might want to address that but it sounds like there's maybe a lot to discuss and then it might be something we want to formally pleased well and also worthwhile putting on the agenda of discussion

156with um the liaison committee with the city explore what options we have to to promote and enourage I think it's pretty multifaceted and and not necessarily directly I mean I think there are components of it with what we've talked about tonight but I think it might deserve its own discussion to to extend a little bit um we are engaging with the firm to do a developer fee study um they have collected information from us and we're looking at um early spring late winter to present something to the board and at the time we'll have a representative from that um firm to be able to speak and that'll be a time for you to ask a lot of these questions and determine you know why we should use develop fees what's going on and they'll be

157able to provide all that information the end result of that is is to potentially look at what we are charging for developer fees to make sure that it's with the going rate that the state allows and to be able to talk about that and so we anticipate um Sometime Late spring that we would bring a resolution to this board to possibly adjust those but it might be a good time to convene and ask a lot of those questions when we get there okay okay so that sounds good can I just something that came into my mind so conquered is working on their housing in the uh the Naval Weapon Station and you know if they do build what they're planning to build they may not have enough schools to house all the families that hopefully

158will move in are we able to work with the county to maybe get like a Northwest section of the development there to come to our schools so school districts have boundaries and we're that's not within our boundaries but when they build schools the developer comes in and build or builds homes and they don't have enough schools they do um they have to build schools to accommodate that's part of the whole development plan so whoever the developer is if there's housing and they know they can't fit them in Mount deblo because I think that's Mount Diablo right the name of they'll the developer is responsible for um incorporating that into the plan yeah in order to make that change you would have to have both districts agree by resolution to essentially Annex or to be able

159to pass that along so M could make that choice but we could not do it for them but it there's something it entertain I know that school districts do this sometimes when there's strange boundaries like a freeway will run through an attendance boundary that was unexpected and then you have the separation between two different groups um but it it takes a large coordinated effort by those districts to do so and with declining enrollment I don't know if Mount do Diablo would even be interested in Pleasant Hill and Mount Diablo Pleasant Hill has TR been trying to defect for years from Mount Diablo into its own for because they have their Pleasant Hill Elementary and Middle and they they don't have a high school but I think they did at one time College Park but they

160used to have a pleasant M Hill High School yeah but um they've tried I remember twice so far that they've tried to separate from Mount Diablo Mount Diablo won't let them so has Northgate northgate's tried to pull off with Walnut Creek intermediate and and that area as well Clayton went to a charter school because they couldn't right pull away success they're not um I don't I don't know that they're so open into letting their Ada go their enrollment but we could ask okay I don't want to get too far off track it does feel like there's good discussions lots of um housing elements and lots of potential here but it sounds like this is going to be kind of coming back on our radar in the spring so for now we do need this resolution

161passed in order to continue charging developer fees I'm guessing we have to pass it by December 15th otherwise we'd get an audit finding which we'll talk about it the next okay so there is a timeliness to this but it can always change in the future so if there are no further points of discussion we we do need to make a mo a motion um I move to approve the resolution seconded Marisol I Courtney I Yasmine I Tanya I Carlos I I motion carries 18.5 is approval of the 2022 2023 annual Financial audit report for Martina Unified School District also presented by Andy Cam uh usually we do this in January but we did received this um this last month and so we decided to go ahead and put it on the agenda for now um

162we are required each year to go through an independent audit we are able to choose the firm and the firm that we have worked with for many years now is chrisy white and they um conducted an audit with our our support we gave them lots of documentation and the report that's attached in the board presentation is the result of that audit with our contribution to it and it spans the time period of fiscal year 2223 so it began with July 1 of 2022 and it ended as of June 30th 2023 um so what does the audit report do um what they're doing is they are looking at all of our information and they are essentially making sure that we followed the rules set forth in Ed code and that we followed acceptable accounting practices so

163specifically they're looking for opinion reasonable assurance that financial statements are correct and they're looking at both state and federal compliance um they do give an opinion it's an unmodified opinion that means we don't get to change it so if they came through and said you did a great job we can't tell them we didn't and if they said we did a bad job we can't dispute it this is their report based on our information um so what do we do we open our books to them and they review all of our information and they provide this unmodified opinion and it is based on um their opinion of the financial statements that they looked and making sure that adequately reflects truly what are in our books um in their process of review um they are looking

164for our internal control procedures and if you look here at the green bulleted things they said that there was no significant deficiency there was no material weakness and we complied with all of the material and financial statements as required they did test our federal funds and so they looked at um almost $5 million of the federal funds that we had of that they looked specifically at our Sr and gear of 2.3 million and special education of 1.1 million and again positive news they found no significant deficiencies and no material weaknesses in how we collect record and use those funds um they also look for um certain categories um and you'll see all of these listed in the table there in the middle of the screen um attendance teachers um kindergarten instructional time instruction materials and

165so forth uh they looked for procedural data and make sure that we comply with all of the state's uh mandates and again if you look at the bullet points they found no significant deficiencies no material weaknesses and no findings based on our K12 audit guide and so ultimately what they're saying is that we passed with the clean bill of health our audit um was successful and they found that uh we did a pretty good job so I would like to ask the board to approve the audit report um dated June 30th 2023 all right thank you and thank you to you and your teams I know this is a lot of hard work that goes into this so we appreciate that question and I just have a kind of question this is whenever I come

166across Audits and and even in my field it's it's kind of begs the question like how do you how do you fail on audit how do you you know how do people get off the rails so you know so bad because a lot of what we do is is either you know checking the box and making sure we have the files and we're doing that uh correctly so is this I guess the question is um do you have any experience or knowledge of other districts that don't pass the audit that get themselves in trouble and if so how are we doing so well protecting ourselves well a lot of times it comes down to you know um like Ticky Tac type of things what people would say um so for example last year we had

167a transportation um uh policy that we had to put in place before April of 2023 there are some districts who waited until after April didn't do it till May or June it didn't substantially change the revenue it didn't change really the reality of how they did business but because they missed that deadline they would get an audit finding and so the audit finding would say essentially slap on the hand you missed this deadline and you didn't do this correctly so that's what they look for um they will look for things like you know meal applications and your free reduced data did you do everything correctly did you um ask for the right application did you make sure it was signed did it have the valid information in order to test it they might ask for

16810 samples and they'll give you random um name of individuals that they look at and when they go through and look at all that data they look and say did you have a process that worked did you complete it accurately and if you don't they can give you an audit finding so they actually get really detailed in um deep into the work that we do so how do we become successful and maintain success over the years it's just having really internal controls that your business department knows very clearly that we check over and over again that we reconcile how we do our work and that we have a partner usually come in and look at it for a second or third time um what's beneficial is that the auditor really works with you um so

169there's great direct communication if you have a question how do I do this or what do I do they share information um and that helps us a lot and then we're able to correct things before it goes out so if we see something in the audit process that we know is wrong we didn't get corrected sometimes it's just a typo thing um we'll get that fixed then we'll give it to the auditor and then they can rep back that there were no findings um but I think that's the essence of it is good communication um strong leadership in the business department and just being as thorough as possible thank you we do appreciate the uh this successful audit all right do we have any public comments okay well I don't mean to pick on the

170school district where I want this school but if you ever want to see uh a bad audit check out the check out the West Contra some of the West contracosta School District's audits that's say that the St their forensic audit for their uh Bond program about a decade ago was a real doozy caught the attention of the FBI but um I do want to just commend the district um and the the budget officials uh for the responsible strong financial stewardship of the district's finances uh that's been a you know I've come to a lot of these meetings over the last six five six years and I've criticized you guys about a lot of stuff but one common theme has been that you've managed the budget responsibly and well um you know despite some of the

171public pressure uh you get uh around contract negotiation times um but you knew you know what your responsibility is in terms of we do best by our children by making sure we keep our financial house in order first and foremost because again going back to the district where I went to school I was fortunate enough to get out of there right before it totally melted down in the early 90s um but it was really ugly and that District never really has recovered and it's had more financial failures um as the years have gone on um so uh you guys have done a good job with your accounting and your financial management and um so with that I think this is the only time I've ever come here and I've never criticized without criticizing you guys

172about anything so anyway there you go probably will never happen again well we'll take it for tonight thank you all right I'll go ahead and make a motion to approve the 2022 2023 annual Financial audit report for Martinez Unified School District second all right Marisol I Courtney i yasine i t hi caros I I motion carries we do not need number 19 yeah and um and I will say so we I we want to hear from everyone uh unless we want to make a motion to extend I would request that everyone be somewhat brief with their comments we'll start with superintendent Rossy well I'm not going to be brief oh okay um you going to take a first after all this financial talk tonight I would like to publicly thank Linda grundhofer um Linda worked

173for our district a long time ago and she um she knows her stuff she's worked all over she when a district gets in financial trouble um she gets sent there to straighten things out all up and down the state and and she's um she's uh slowed down a little bit for health reasons but Linda has personally trained myself Andy and The Bu juny our business department would you get that timer off the business department and it's because of her that that we are we do what we do and second of all um started moving John sweat um School moving into the school on Thursday uh we moved most of the kitchen and the main offices and the technology began on Thursday and Friday and on Sunday morning at 5:00 a.m. I met our maintenance staff

174custodians and uh um some Grounds Guys whoever wanted to volunteer and we started moving we were just going to move the classes the five classes that had to go be ready for Monday but we actually moved or they actually moved three days worth of classes and they were back there to today they should probably finish moving most of the stuff by tomorrow if not done and then the teachers and students will come day by day and Friday will be the first day at John sweat with um Everybody in the in their new home so it's very exciting it was a long time coming and I just want to thank I I want to thank the teachers for for doing a great job packing with their support staff helping the admin for the management because that

175is a big school that's our biggest school move our facilities crew and department and uh maintenance ground and custodial for everything that they did to make that easy and um last but not least however you celebrate have a happy holiday enjoy your winter break and your time off and um we'll see you back here in this boardroom in January all right well I just wanted to congratulate Courtney again and Carlos and Tanya and thank you for the opportunity this year for serving as president I um I don't know that I'm going to miss running the meeting so much but I have learned an enormous amount in a lot of that is thanks to Helen and our weekly meetings and I think you know we have scored bylaws together and we have emailed the attorney and

176we've looked at procedures and um I think that we have really collectively as a board I'm really proud of how far we have moved in a year being so new and having a new superintendent of course with a ton of history history in the district but still kind of all learning these roles I'm really proud of how far we've come and I'm excited to see what the next year brings and um to Echo Helen sentiment there's so much happening in the world that I think is really important to remember that this is a season where religions all over the world cultures all over the world are celebrating something and to be kind to each other and um you know take a minute to learn about someone's culture and and wish them a happy holiday so

177happy holidays to all of our musd family I'll Echo that and uh Annie thank you for your your service as president for the past year um and have want everyone to have a safe uh holiday Christmas break um I did want to make the announcement I did a presentation in Amry cabal's class or engineering principal class we are uh starting off the ace Mentor program next semester and um it is still open for enrollment and so any parents listening and whose kids might be interested in architecture construction or engineering we are uh starting off the program next next year and so enrollment is still open and registration necessary so uh excited to to be kicking this off again um in January I just wanted to say um I thought the conference was um very good

178this past in San Francisco and I really enjoyed it so um I'm glad we were able to attend and um if you missed the Winter concert at alhur high school you missed a great performance um concert band and Orchestra and Jazz asz band it was really um it was wonderful it was very nice um they had hot chocolate they were doing a little fundraiser for hot chocolate um but it was and the performances were fabulous um and also everyone have a um happy holiday and a safe holiday and um it's like two weeks and like one day or two weeks and two days off so um enjoy your family and friends thank you so I thought of another idea to make the district money no so I found out that if the spot the the

179half of acre apparently that we have if we put bees on it um Napa wineries are renting Queens for like $1,000 per quarter so if we have a bunch of beehives on that half of acre and rent these queen bees to these wineries we could make money for the district maybe teach a class related to that to the kids just wanted to throw that out there all right there as well I know this has been a very long meeting but to finish it up I just wanted to say a Merry Christmas or whatever you celebrate and a Happy New Year's and to good luck to all the musd students finishing off 2023 strong and welcoming 2024 with new experiences and good grades and all of that so all right Courtney yeah um thank you Annie

180for your um your presidential presence the last year uh you did a good job with a difficult job and um I'm looking forward to having that gavel in my hand it's every lawyer's dream um just kidding uh but I I am looking forward to the coming year I think we did a lot of good work in the last year and um we do have some tough decisions ahead but um I know that as a board we will do our best and um I hope hope everybody has a very safe and fun and relaxing holiday break all right wonderful so with that we will adjourn at 9:24
