I'd like to call to order the Mount Diablo Unified School District School Board meeting for May 13th, 2026. I'm going to do roll call. Trustee McDougal. Present. Trustee Lawrence. Present. Trustee Mann. Here. Trustee Mason is here and Trustee Nzeiwu has not arrived yet, but I haven't heard so I think she'll be in in any minute. Okay. So, we will move on to our public comment. I believe we have one this evening. Thank you. Salman? Yes. Go right ahead. I'll push the talk button? I'll push this one? Yep. The little light should turn green. Okay. There you go. Okay. >> Got it. Uh good evening. Um my name is Salman. I'm a Bancroft parent. Um I understand that regarding Bancroft, the board will be meeting with legal counsel in closed session. Before you do so, I'd

like to ask you for two things. One, whatever you are told in closed session, I ask you to please prepare responsibly for all possible outcomes of the full legal process. That includes if the district is forced to correct course. That means thinking now about staffing, classroom space, sibling applicants, website enrollment, and how Bancroft dual immersion kindergarten would continue for the '26-'27 school year. Planning ahead is not capitulation. It is not weakness. It is just the responsible thing to do. The superintendent made a decision and is defending it. I get that. But this board is the elected body. This board is accountable to the families in this district. I'm asking you to use your authority. You can support the superintendent when he is right and still ask to fix what went wrong. That is oversight. That

is your responsibility. And the second thing, we're all parents here. Please do not lose sight of the really little kids directly affected by this. I know siblings get split up all the time when one of them goes to middle school. One of those kids is 11. Their younger brother or their younger sister always knew that would happen. You think back to when your kids were really little, for a 5-year-old who was going to walk in the big kids school for the very first time holding their older brother's hand, holding their older sister's hand, there's no replacement for that. That's an injury that can't be corrected. The community concern is not over. The need for a lawful, transparent process is not over. Please, pause the phase out, fix the process, and work with the families you

were elected to serve. Thank you. Are we going to close session? Our um agenda will be the board may discuss negotiations and provide direction to represented regarding represented employees pursuant to government code section 54957.6. 3.2, possible discipline, dismissal, or release of public employee. 3.3 The board will meet in closed session to discuss the following matters: conference with legal counsel, existing litigation under government code 54956.9D1. Gozney versus Mount Diablo Unified School District, Contra Costa County Superior Court case number C24 -02021. Mount Diablo Unified School District versus Timothy Day, Contra Costa County Superior Court case number N26-0631. Mount Diablo Unified School District versus Sherry Day, Contra Costa County Superior Court case number 9260632. MP versus Mount Diablo Unified School District Office of Administration hearing cases number 2025080440. Bancroft Dual Immersion Family Association versus Mount Diablo Unified School

District, Contra Costa Contra Costa County Superior Court case number 9 N260580. 3.4 The board will meet in closed session to discuss the following matters: conference with legal counsel, anticipated litigation, significant exposure to litigation, government code number 54956.9D2, two matters. 3.5 Stipulated expulsion agreement for student number 14-26. 3.6 Stipulated expulsion agreement for student 15.
