Okay. I'm going to call to order the meeting of the Mount Diablo Unified School District um for March 25th, 2026. I'll start with roll call. Trustee Lawrence? Trustee McDougall? Here. Trustee Zambwe? >> Here. >> Trustee Mayo? Here. Trustee Mason is here as well. Okay. Do we have public comment? It's okay. We can do it. You have to wait. Okay, we have John Kelly. Hello. My name is John Kelly, and I'll keep my comments to less than 3 minutes. I have a timer, so I'm going to run that on my screen so I can see what I'm what I'm doing here, folks. Um so uh good afternoon. I'm here today on behalf again of the Bancroft Dual Immersion Parents Association uh regarding the Dual Immersion Program at Bancroft Elementary. Um I'm here tonight because the counsel

for the district has closed the door to any further discussion with the Bancroft parents on this matter. Uh I want you to understand. Hopefully, I can help understand the record before you go into closed session. On March 6th um we I sent a letter identifying 22 specific violations of the education code in the process leading to the January 28th decision. Uh we cited the statutes by number and we asked the district to pause and to please follow the law. Um The district responded and asked for an extension of time uh which we granted. Um they uh they requested until March 20th to do that. And we said, yes, no, we will we will give you that extra time. Um March 20th came and went and we did not hear anything from the district. Uh on

the 23rd um we we had said we would go in to court on that point, but I suspected something something had gone wrong. It's just seemed not plausible that the district wouldn't get back to us at all, even if it was just to say we don't have anything to say. Um so we sent a further letter saying, look, please, can you tell us what's going on? Um I received back a uh a letter from the attorneys for the district uh letting me know that they'd had a typo in my email address and that it they'd sent something on the 20th and hadn't been received. So we took a look at the letter and the letter had some serious problems. Um first it uh cited code sections 4,000 code sections apart from the actual law that

governs this. It told us that the special education statutes governed the LCAP process, and they just don't. Further, the district proceeded to answer a series of questions we hadn't even asked. One of the issues that keeps coming up in the determination process is what documents were relied upon. Um no documents were identified in a privilege log. The district merely asserted they had the right to hold documents back, but they didn't address the issue of the privilege log at all. I want to be clear, only three of the 22 points we raised were even addressed. We got back to the district right away about this and let them know, hey, look, there's we want to meet and confer with you. We want to try to find common ground if we can. The whole point here is

to prevent additional money being spent on this. And we received that correspondence from the counsel for the district that just said, no, we're just not going to talk to you anymore at all, and we don't have to answer these questions. I'm sorry, but your time's expired. Thank you for your time. >> Thank you. Okay. So we are now adjourned into closed session. Oh, didn't read the agenda. Um See, you distracted me. It's all your fault. Okay, we're going to go into closed session.
