001Good evening everyone. Um, today is November 12th, 2025 and I'd like to reconvene the uh meeting of the Mount Diablo Unified School District U Board of Education. And we had roll call uh prior to close session. Everyone was present present and our student trustee um Barrera Oriana has joined the meeting. So we will move on to the preliminary business 6.1 land acknowledgement. We recognize that the Mount Diablo Unified School District sits on the territory of the Confederated villages of the Lassan, the ancestrial and unseated land of the Bay Miwok and northern Yok, the successors of the sovereign Verona Band of Contracasta County. As members of the Mount Diablo Unified School District community, it is vitally important that we not only recognize the history on the land on which we learn, but also we recognize that

002the land we inhabit and learn on is the ancestrial land of these people who are alive and flourishing members of the Mount Diablo Unified School District community. Um, Mount Diablo Unified School District and broader Bay Area communities today. Would you please stand for the pledge of >> allegiance to the flag of the United States of America and to the republic for which it stands one nation under God indivisible with liberty and justice for all. >> Amen. >> Thank you. Um, first 6.3 is review and approval of the minutes for the regular board meeting held on October 22nd. >> I make a motion that we accept the minutes as presented. >> Second. >> So, we have a motion by Trustee Mason with a second by Trustee McDougall to approve the minutes uh for the meeting October

00322nd, 2025. Further discussion. Um, Trusty Barrerero, Ariana, how do you vote? >> Yes. >> Thank you. It's not. I'm going back in. Yeah. >> And the motion to approve the minutes for October 22nd is approved on a 5000 vote with the support from our student trustee. 6.4 is the approval of the agenda. Uh Dr. Clark, are there any changes? >> Yeah, Madame President. Um I would like to uh move item 17.5 to 17.1. Um ma madame president um I would uh in addition to that I would uh request that we move what is currently item 17.1 to be after the superintendence report and prior to uh the consent agenda. >> Okay. So Mr. Clark Dr. Clark, what was your um 17.5 you were going to move? >> I had a request to move 17.5 earlier

004in the meeting and so since it's a business item, I moved it to the to the very front of the business agenda. I will >> and that was a mistake on my part. >> Okay. >> So, if we if if it pleased the board, I guess my my request would be to take uh item seven. I think we could leave 17.5 >> where it is. I would request that we move item 17.1 to be after the superintendence report but prior to the consent agenda. So I'm not don't have my my papers are stapled. Please. Thank you. Pardon? >> Second that. >> Um, so the consent agenda would be adopted as presented except for moving 17.1 to after >> the agenda. Sorry, >> I'm sorry. Thank you for the correction. Approve the agenda with the exception

005of moving 17.1 to after the superintendence report but before the consent agenda. >> Yes, please. >> Okay. >> Can I have a second from uh >> second with Mr. McDougall? >> Trustee Barrera Oriana. How do you vote? >> Yes. And the motion uh to approve the agenda as restructured is approved on a 5000 vote with support from our student trustee. Okay. Now I will be reporting out on the close session items that were um deliberated by the board of education. Existing litigation. The board met in close session with legal counsel to discuss a matter of existing litigation pursuant to government code 54956.9 by a vote of 5 to zero in the matter of Bailey versus Mount Diablo Unified School District US District Court ND California case number 324 CB0000188-C the board gave direction and settlement

006author authority to the general counsel under the subject of anticipated litigation. In two matters of anticipated litigation, the board of a by a vote of 5 to zero authorized the general council to initiate litigation in both cases. In the matter of one case, anticipated litigation, the board by a vote of 5 to zero, gave direction to general counsel. The next item, consideration to hear appeal of a decision in a complaint against an employee per board policy 1312.1. In one matter, the board voted by the board by a v vote of five to zero decided to not hear an appeal of complaint against a district employee pursuant to board policy administrative regulation 1312.1. Student matter consideration of student records challenge education code 49070. In consideration of one student record records challenge the board decided to deny

007the challenge. And in the final matter discipline dismissal release or reassignment of public employee in close session by a vote of 5 to zero with zero abstensions. The board took action to approve the resignation of one employee per a separation agreement. And that concludes the action um report for close session. Now we are ready for public comment. Do we have uh cards? So, we have one speaker card. Um, the public may address the board regarding any item not on the agenda. Public comment will also be allowed on each specific agenda item prior to the board action thereon. In accordance with the Brown Act, the board may not take action or engage in dialogue on items that are not on the posted on the agenda. And since there is but one speaker, we will u the

008individuals will have three minutes to speak. And our speaker is Brett Andrew Halt. Good evening, board members. Uh Dr. Clark out in the hallway. Um, I am really pleased that we have come to a tentative agreement between uh our district and our teachers. And I wonder with that tenative agreement, the process at which the road that we travel down to get here, if it didn't have to be this way, every time that we begin a new bargain with um the district, it does feel like the district is out there trying to gain the maximum amount of leverage um as one might go into a bargaining deal for a business deal. And I bemoone the process that we as a union are constantly put through to try and scrap and claw and demonstrate and speak out

009and engage just to get to the point where we are given a livable wage. wages that barely keep up with the cost of living. And so when we begin this bargaining process uh a couple years from now a new I wonder if all of you as board members might empower district leadership to begin and to come to the table ready to really discuss the problems that are facing so many of our specialists in this district. to come to the table re ready to really engage on the state of special education in this district and to really be ready to bargain those things. Not starting off as if we are on opposite sides of a giant pendulum but starting off with fair offers. It is incredibly taxing on our teachers to go through this process time

010and time again just to get what is fair. And we would love as a union thinking about next time this process might not have to be like this. And I would appreciate you all to empower district leadership to think in those terms in the future. Thank you so much. We're ready to move on to 9.1 communications. And our spokesperson under communications is uh Mrs. Ortega. Welcome, Linda. Good evening, President Mayo, Mrs. Mayo, trustees, Dr. Clark, members of the audience. I am pleased to report that the Mount Diablo Education Association Media members have voted to ratify the tenative agreement for the 202526 through the 2027-28 contract between media and the district. I would like to thank the media bargaining team and organizing teams, all of our media members, our union siblings, parents, members of the community

011who stood in solidarity in our efforts to settle this contract. I also want to thank the trustees and members of the MDUSD bargaining team who who also worked to settle this contract and I appreciate the many uh conversations and hours between the two parties to achieve this agreement. It was a joint effort and I am so appreciative of all the work both parties did to get this contract settled. However, our work is not done. As Brett has mentioned, there are still so many items that I have been working on with the district management on behalf of many of my members and in support of our students. I continue to look forward to working collaboratively with district management on how to solve these problems before they directly impact our students and our educators. And I do

012want to echo what Brett has said. um we need to get to a place sooner than later and and talk about these issues now before we have to go meet again at the table. These items cannot wait. Also later in the agenda, you will be presented with the MDUSD's adult education sunshine letters for your consideration. Media has welcomed the adult educators and coordinators to our association. Medadia is looking forward to negotiating adding this new section to the contract. And as the president of Medadia and some of you have noticed on the Facebook page, I am one who is very dedicated to public education. I will continue to advocate in the local, state, and national level for what is best for our students, our educators, and our profession. Thank you. Thank you. So, Dr. Clark, we're

013ready for 10.1. 10.1 is review and potential approval of board resolution 25/26-34 authorizing the issuance and sale of its 2026 certificates of participation not to exceed $40 million. And with this I call uh Adrien Vargas to the podium. >> Thank you Dr. Clark. Um, so with me tonight I have Rachel Chang Kauawaii who will help me with the presentation and I also have Chick Adams who's our bond council and will also assist in answering any questions. So um just a brief overview um the cops or certificate of participations uh will help our facilities funding program. Um, we also uh had a a cop issued in 2018 uh that was repaid with the measure A annual special taxes. The final payoff is in September of 2026. Um we have exhausted that I believe was 20 million

014that was issued out. Um, and so we're considering a 2026 COP. And listed, um, are some of the projects that we will be working on. the athletic facilities and field at College Park High School, the aquatic center, replacement at Pleasant Hill Middle School, roofing projects at Hullbrook Valley Verie, uh Glenbrook, Mount Diablo High, and the Dent Center, and then improvements of student and campus safety, uh and security measures at various sites. Um again this issue issuance would uh supplement our facility projects and continue um our modernization projects as we look towards November of 26 for a geo bond. Um and again uh the 2026 uh proposed coops is in alignment with what the district did in 2018. So with that, I will turn it over to Rachel so she can go through the the different

015options we reviewed. >> Thank you very much, Mr. Vargas. Good evening, President Mayo, members of the Bor and audience. Um, as Adrian introduced, as we are uh evaluating the proposed financings, we looked at 10 plus different structuring options to make sure it's the most appropriate for Mount Diablo Unifi as a organization and also for your communities. but most importantly in um allow you to finance those needed facilities that age Mr. Vargas shared earlier on this slide. So here we have listed a spectrum of the these u structuring options and three specifically are on this slide. As you can see there the goal is to provide roughly $30 million of um project and that is structure over different bond terms. So I'll quickly go over the items shown on the table here for options A. So,

016as you can see, the bond term under option A would be 25 years. And as we move uh over to the tables for options B and C, you see a shorter bond term. To be more consistent with what we currently have, the 2018 COP's outstanding. So, those specifically are 10 years and eight-year bond terms. So, same principle amount. And as you can see, the annual debt service certainly vary. It's very similar to comparing a 15-year home mortgage to a 30-year home mortgage. While the 15-year home mortgage would provide a lower overall interest payment, but the annual payment or monthly payment would be higher. So, that's summarized here. So, you see uh between option A, B, and C, that annual debt service range from 2.3 million to about $5 million. Again, these numbers are preliminary and

017estimated based on current market condition and some level of conservatism built into it. We'll continue to monitor the market and we certainly will only execute the financing um shall the board approves it tonight uh and should the market cooperate. And moving on to some of the other numbers on this slide. Number four here is very important. We want to be mindful of what the measure A special taxes you currently are collecting every year which will continue with or without the COP financing. So your team has uh consolidated that information and that amount is 6.67 million. As you can see it does not change over the different structuring options. So the annual surplus special taxes is simply that 6.67 67 million subtract your annual principal interest repayment on this proposed COP financing. So, as you can

018see, under uh either of these options, any of these options, you continue to have annual surplus special taxes to help you pay for any pay as you go facility projects. And uh the the death service coverage is shown here as well with the total debt service. Again, the longer bond turn has a higher overall the service payment as compared to for example option C that has the lowest overall interest repayment. And the other figure I know in uh other of our presentations we've discussed this which is the repayment ratio item number eight here that shows you for every dollar you borrow how much you're paying back in total. That's both principal and interest payment. So that repayment ratio range from close to two to 1.3 to 1.27 under the different options. On the next slide

019here, we're showing a graphical representation of what the repayment would look like when compared to your measure 8 uh special tax revenue that $6.67 million annually. And as you can see, the bars are the principal interest repayment and that black line is your measure A special tax revenues. And in year 2026, as Mr. Vargas uh introduced earlier, we still have that one last payment of your 2018 COP. And that's in the blue bar and the proposed 2026 are those green bars. Um so here is to show you how much uh cushion we have under your 6.67 million special tax. is to be collected and how the structuring of the proposed COP would look like. Last but not the least, uh we have put together a uh preliminary timeline for this financing. Uh the team started

020working on the structuring consideration, a lot of financing documents back in September. Since then, we completed the required county disclosures um to both Contraosta County Office of Education as well as the auditor controller. We've also received their letter of recommendation uh stating that the proposed COP financing plan is reasonable. We have also reached out to the credit rating agency for every of your financing. think this is a very important process that we present the most updated financial and tax base information to the rating agency. Uh we're uh scheduled to receive that credit rating back by the end of this week before we proceed with some of the next steps. Tonight we're here for the board to consider the the COP financing uh that will allow us to complete all the other required legal administrative steps

021in the process. so that in January we'll be in a position to enter the market and hopefully lock in interest rates. That January timeline is a um thoughtful decision understanding that just taking a step back looking at the municipal bond market. We know we've all heard about volatilities in the interest rates, the Fed's decision, the government shutdown, a lot of things that um are are on uh investors and of course issuers minds. But um taking a step back and looking at the interest rate history, one observation we have is that you see um a decrease in supply or issuances come January because a lot of times people would try to rush to the market before the end of the year to complete those financings. And with holidays and everything, you certainly see a drop in

022that issuance volume in January. And um that supply demand imbalance a lot of times benefit issuers that we generally historically see lower interest rates. So we're hopeful that we see the same trend and be able to lock in favorable interest rates on behalf of the school district. If we hit that timeline, we'll be able to complete all the post sale activities and close the financing and deliver you the $30 million project funding by February 12th. That concludes the slides that we have prepared and we're happy to answer any questions you may have. >> Board members, do you have questions? >> Mr. Lawrence, >> um the the difference in the interest payments on the 25, the 10, and the eight. Is there a different So, obviously, we're paying more interest if we're paying over 25 years.

023I I presume that the in we're projecting that the interest rate would be higher for the longer term bond. Is that correct? that the 25 would be substantially higher than the the 10 and the eight which I imagine would be pretty closely tied. >> That's correct. So when it comes to municipal bonds um since bonds of every annual maturities are being issued so but that statement is accurate when you look at the blended interest rate for the financing of option A, B and C. Option A would ultimately have the highest interest rate as compared to option A. Mr. McDougall. >> Yeah. I have a question. Uh, you say you're waiting for the credit rating to come back by the end of the week. Um, what's our credit rating now? >> So, for your general obligation

024bonds, you currently have a double A3 credit rating with Moody's Investor Service with a positive outlook. That was a a positive news that we obtained back in um March this year for the general obligation financing for your coop. It's customary based on the rating agency's rating criteria. The coop since it's not secured by all of your properties within your school district. It has a lower credit rating. Right now your outstanding 2018 coops are rated A2 which is two notches as we call it two uh levels below your go. So we're hopeful that we can u continue we can secure the same credit rating and hopefully with that positive outlook as well. >> Okay. So you're optimistic that on by Friday we'll get a similar rating to a double A3. You said >> uh for the

025go double A3 and for the cop is A2. >> A2. Okay. And I've heard that the mortgage rates are going down uh on the residential markets. Do you expect to see that similar drop in the market for this? So both the uh municipal bond interest rates and mortgage rates they trend um based on the benchmark as we look at the the the treasury interest rates. So we have certainly since ear um over the past six month while it there are ups and downs generally they're trending downwards. So, we're hopeful, especially um with the targeted pricing in January to lock in the interest rates. We're hopeful that we'll see favorable interest rates that will continue to trend downward. But at the same time, uh just to to out um out of caution, right? There's still a

026lot of things that are outside of our control. what the Federal Reserve will continue to do. Will they continue to cut interest rates? If they continue um the the same trend that they have done in the last two FOMC meetings, that statement is absolutely correct. You will continue to see residential mortgage rates and bond interest rates to trend that way. But supply demand is a consideration. Geopolitical other risk are also factors that would move the municipal bond interest rates. Just as a matter of interest, what is our rate now on that commercial market? >> So for the um for your bonds, yes. >> So one of the benchmark that we look to for tax exempt municipal bonds is what we call municipal market data. They track only tax exempt interest rates. So for that sitting

027here right now 10year which is roughly that option B or C we're looking at but um that rate is for AAA rated issuer right so higher rating the most liquid but that benchmark 10-year benchmark we're looking at roughly 2.9% sitting here right now >> so we wouldn't be quite that low and a double A or single A like you're talking >> so for the numbers that we prepare for good faith estimate for the resolution in front of the board um have some conservatism built into it. But if we were to proceed with option C, which is I believe Mr. Vargas direction to the financing so far, option C would um lend us roughly 4.9% for that blended true interest cost. >> Okay. So who pulls the trigger on whether we take option A, B or

028C? So my recommendation is option C. Uh and when I look at that recommendation one, um I'm looking at the repayment ratio. So that's the lowest and also it's something that the district has already experienced in terms of you know an 8-year uh payout. Um also after eight years and then the district can re-evaluate and come back for another coop. Rachel and I, you see three options. I probably had her generate six, seven different options. Um because, you know, we talked about just the value of money. Like I I mean, even playing with 20 million to 30 million and um but for me it you know, my recommendation will be the 8-year um just because of the flexibility it provides and then also again just looking at that repayment ratio. Thank you. >> Any further

029questions? >> Are we ready for the vote? >> Sure. I move to approve resolution number 2526-34 authorizing the issuance and sale of its 2026 certificates of participation not to exceed $40 million. >> I'm sorry. is a point of order in the motion. Should we be determining A, B or C or does that happen separately? Um, it would if you could include choosing C because that would be the recommendation in the vote that would help along the process. Just amend it. >> Please restart it. Okay. Restate your >> I move to approve resolution 20 number 25 26-35 authorizing the issuance and sale of its 20 26 certificates of participation not to exceed $40 million utilizing the C option. I'll second that. >> Okay. So we have a motion by trustee Enzwi with a second by trustee

030Mason regarding the approval of resolution 2526-34 and option C. Um the um for our student trustee I was advised that you um should not vote on this particular item. So we will follow that recommendation. Okay. Uh the motion to approve resolution 25/26-34 uh as presented with the selection of option C has been adopted on a 5000 vote. Thank you very much for your presentation and all the work that went behind this. We look forward to the projects. Thank you. Dr. Clark 10.2. >> Madam President, I bring um I bring resolution uh under item 10.2 two, uh, review and potential approval of board resolution 25/26-35 for personnel with provisional internship permits. And, um, and so tonight we bring to you uh, one individual that we are, um, asking for approval for. I move that we approve

031resolution 2526-35 provisional internship permits. >> I'll second that. >> We have a pro um motion by trustee and with a second by trustee McDougall regarding uh item 10.2 which is the resolution for um provisional internship permits 2526-35. Trustee Barrera Oriana, how do you vote? >> I'll second. I mean, I'll say yes. >> Thank you. I promise not to sing. Item 10.2 is adopted on a 5000 vote with support from our student trustee. Thank you very much, Dr. Clark. Item 10.3. Madame President, I'd like to um bring forward uh the potential review and potential approval of board resolution 25/26-36 for personnel with variable term waiverss. And with that, they just need um additional time to complete all the necessary requirements. And I bring five individuals forward for that. >> I make a motion to approve resolution

03225/26-36, variable term waiverss. I'll second. >> So, we have a motion um on item 10.3. Um Miss Trustee Mason voted um voted moved with uh uh Trustee Barrera Oriana providing the second to approve the resolution 2526-36. Trusty Barrera Oriana, how do you vote? >> Yes. Thank you. And this motion is adopted on a 5000 vote with a support from our student um public employee appointment. Dr. Clark. >> Yes, Madame President. Um I'm going to have the HR department uh provide this provide this um next item. >> Good evening members of the board and Dr. Clark. The human resources department is bringing for the board's review and potential approval the appointment of Rory Okconor as the district athletic compliance officer. Rory Okconor has worked across collegiate high school and youth sports settings with a focus on

033student development, academic success and program culture. He has led athletic programs, built compliance and wellness systems, and created pathways that support student athletes in both performance and personal growth. Rory earned his Bachelor of Arts in Sports Medicine, Master of Arts in Coaching and Athletic Administration, and Master of Science in Exercise Science from Concordia University, Irvine. Originally from Ireland, Rory is passionate about service, mentorship, and building community focused programs. He enjoys spending time with his wife and family, supporting local causes, and continuing his education and professional learning. With that, I leave this appointment in the hands of the board. Thank you. >> I move to approve the appointment of Rory Okconor for the district athletic compliance officer. >> Second. We have a motion by Trusty Mason with a second by Trustee Lawrence in uh the approval

034of appointment for uh Rory O' Conor as the district athletic compliance officer. That's a mouthful. [laughter] Um further discussion trustee Barrera Oriana, how do you vote? >> Yes. >> Thank you. and congratulations. Your appointment is approved on a 5000 vote with support from our student trustee. Welcome. >> You um just say thank you very much to the board, Superintendent Clark, everybody involved. It was a nice easy process um though thorough and so I appreciate Yeah, very thorough. I appreciate everybody's help and uh look forward to to getting going and like I said my first taste of athletics there with the heart racing during the vote but we're good. [laughter] Thank you very much. >> Thank you. Welcome aboard. >> Okay, we're ready to move on to board member reports. Um Trusty Enzi, would you like

035to go first? you all will cover our um our lovely reception last week. So I won't I won't provide that. So um thank you everybody for voting. That's it. >> All right. Um Trusty McDougall. [clears throat and cough] Uh yes, I attended uh on October 28th the budget advisory committee uh meeting that uh it was interesting meeting unfortunately we didn't have a quorum so they couldn't do any voting but nonetheless um it was interesting to see how they conducted business. On the 29th, um I took a required two-hour uh ethics training course and I did this online from the California local elected officials organization. So now I'm certificated. I'm ethical. So [clears throat] um that's taken care of. I guess we have to do that every two years. On the 30th, I went to the

036manufacturing day. In the morning, we went to the plumbers's training center in Martinez and I went through the class like I was a high school student. Very enlightening. I I like the way they approached the and told the kids about here is a prospect of a job that can earn you good money. You don't have to continue going to uh uh schooling except through their training center and you can earn money within the summer after they start graduating. So uh and into a very lucrative career and a rewarding career. So it's very interesting that how they talked about that with the plumbers and I'm sure it's true true with several other of the trades that uh are available through our programs. In the afternoon we went to a session at center conquered uh that talked

037had talking people from uh DVC and Tesla. Um, we couldn't meet at DBC because they're they're rebuilding their engineering building. So, um, it was very informative to hear about the internships available at DBC and Tesla and they're very aggressive on this, offering quite a few internships and working online with the construction of cars and the summer after you join with them. Uh and then I think we all attended the November 5th building trades parents night and I thought very interesting. It was good reception. Uh lots of speeches from important political people. So I thought that was impressive even a year out from the elections. [clears throat] And on November 10th, just Monday, I attended the Turning Point USA gathering in UC Berkeley, which probably a lot of people have seen on the news. uh got

038a lot of reaction from the uh college students but it was very uh interesting meeting uh inside the building and I enjoyed attending that. And finally um I want to announce that I'm going to hold a town hall on December 2nd uh from 5 to 6:00 p.m. at the Conquered Public Library which is located at 2900 Salvio Street in Conquered. Uh we will have uh flyers out with more information on that. Thank you. >> Um, Trusty Barrera Oriana, would you like to make a report? >> Yes. Uh, on October 23rd, I attended the college fair at Ignatia Valley. It was great to learn more about the colleges and about the application process and, you know, scholarships that I can seek in the future. October 24th, had the pleasure of attending the student council meeting at

039Sequoia Elementary. got to ask them about their school, about their interests, about the they told me about the different clubs they had on campus and how their international boret curriculum worked at their school and at the end I was able to tour tour the school. It was a great experience because I got to learn from the students about their school and to hear from them. The week after on Halloween nights, I got to participate in Scareway Hunger alongside hundred other students from Conquered High School. and I'm proud to share we were able to collect over 20,000 meals for families in need for the Contraostasa food bank. Uh last week I attended the senior night football game at Congret High School. I saw Dr. Clark there and now in the process of playing the next student

040advisory committee next Wednesday. >> Thank you. Very informative. Um who haven't I called on yet? Uh, Trusty Lawrence, >> um, it was fantastic to see all of our board members uh, there at the the career night which was a just fantastic event. Um, seeing Dr. Clark and so many of our staff. We had a huge turnout of elected officials. Um super state superintendent of public instruction Tony Thurman, Congressman Dane, uh city council members uh from various cities. Uh really strong turnout and um there were like a number of families who just as I was going about ran into and it was they were delighted to be there. It was very informative and I think that that event is just going to get bigger and bigger because the response was so strong and I think there's

041just such a a need for um yeah I think it's a misnomer to talk about bluecollar jobs. These are very highly skilled technical jobs and there's a huge demand for these. These are jobs that um are are are great careers and rewarding careers as we heard from our um MDUSD grad who came and told us about his journey through the uh apprentice program and and so just a huge thank you to the staff that organized it and uh again thank you to all the other trustees for for being there as well. I thought that was a a great uh show of support. um grateful for the fact that we have uh reopened the government. 42 million uh Americans who uh benefit from SNAP program uh which is basically providing food are now able to to

042get that again. Um that is something that very directly impacts many of our MDUSD families. Um at the same time in in in a very challenging economic environment for for many people uh millions of Americans are seeing significant increases in uh what they are paying for health care healthcare and that has a direct impact on again many of these same families here in MDUSD and so I am grateful for everyone who turned out to vote and for the passage of uh Proposition 50. Thank you >> Trusty Mason. Well, it's been a while since the last meeting. So, um, we had the DAC meeting and there was a much smaller group of people, I think, because of things that are going on in outside of our control. So, they decided to wait till the next meeting

043to hold their election for their officers. I went to a garden event out in um, Bay Point and Dr. Clark was there. And I want to say that our food services did a fantastic job of serving um a wonderful meal of fresh fruits and vegetables. But I do have to say that the highlight for me that evening was in the they were having a Halloween celebration at Rio Vista. So I walked over and I got to do the uh chaa slide with all the kids in the costume. So that was the highlight for me of the evening. Uh we had a pack meeting, a very good presentation about school enrollment and transfers. And then I went on Halloween to both Belair and Rio Vista and watched the costume parade and was shocked at the amount

044of candy they were handing out to our kids. But oh well, one day a year I guess. Um I visited Mount Dava High School, went by the serendipity program and talked to the chef over there for a little while. Uh I have was on the TIS online to talk listen in on how they're supporting our teachers and the things we can do for our teachers. I did go to the trade show at Conquered High School and then went back the next day to attend the Black Student Union meeting with the kids and played a fun movie game with them. And I thought I was a movie buff, but apparently only of old movies because I only knew one answer. Uh, and then, um, there was a meeting here with the officials from Martinez to talk

045about changes that we could possibly make to make transportation better for the students and families over at Hidden Valley. And then I went to Rio Vista where they had a ELAC meeting for the parents from both Shoreacres and um, Rio Vista and it was very well presented. Um, Lordis presented it and the very informative. It's not that easy to reclassify. We found some of us thinking twice about what what was what did he say? And so it it's not that it's that our kids can't do it. It's it's not that easy to do it. So, and we always encourage them to do it earlier because the earlier they do it, the easier it is for them to do it and then they get more choices as they move ahead. And then um on Saturday, I

046went that to the meeting with the counselors. Uh okay, I'm going to say it wrong. That's it. [laughter] the the um that they have in the community very well attended. They did some games all structured around getting their kids talking to kids now and getting your kids thinking now about what they want to do so they know the more choices that they have to make as they move forward. And that's always good for me. I get to practice my uh mostly listening. I I'm get 75% of everything I don't try to speak it because I just ruin the language when I try to speak it. And um then the there was um a family can meeting that I only mentioned. It's not one of our meetings per se, but it's a committee I've been with

047meeting with. It's a county uh family for families nutrition and activities and they're disbanding because of cuts that we've had and they're no longer going to be able to continue. But those of us that have been there since the very beginning are trying to think of ways that maybe one of the other agencies can take up those meetings because they've really been effective get about getting not only nutritious food to our families but food that our families desperately need. So that's what I've been doing. Well, thank you very much. So I attended many of the meetings that u the rest of you have participated in. One that wasn't mentioned was the college fair at Ignatio Valley High School except for our student trustee did mention it. Um it was packed when I was there and

048um um there was a students were actively engaged with all of the representatives from the colleges and one of the representatives um did compliment me on how articulate our students were and the types of questions that they asked about the colleges that they were interested in. Uh, I just want to mention that the the college fair at Ignatio Valley High School is a volunteer effort and it's with support from the site administration in Mount Diablo School District. So that has been uh the situation since it first began many years ago. On the October 23rd, I also attended the lights on after school event at Meadows Elementary School and there were many parents and student of course students there. uh they were enjoying all the activities of going from room to room to see uh the

049different types of programs that are being presented. There were also some activities out on the plague the blacktop uh and then a kind of a fair area where you could get prizes which was very popular and I had some excellent tour guides. I went to the DAC meeting with Miss Mason. uh the parent advisory committee meeting on October 28th, the budget advisory meeting on October 28th as well. On November 3rd, we had the Contracasta County School Boards Association business meeting and the presentation by Attorney General Bont. And he talked about some of the efforts that are happening uh in his office and uh pledged to provide some more resources um for school districts around a couple of topics. the um went to the TIS or participated on the TISP call on November 6 which was

050a Zoom call and then also I went to the buildings trades event with the rest of you and that was uh as uh Trusty Lawrence shared was outstanding and it was great to see how involved the students were with the representatives from the different locals and um they were asking good questions and and I appreciated the care with which uh the responses were provided. I just want to call out um I want to thank all of our residents uh veterans who re reside in Mount Diablo School District and throughout our country, county, state, and nation who have served and continue to serve in all branches of our armed forces. And I want to thank the families who have supported their loved ones during their service, especially the years following service because sometimes those aren't easy

051times. Everyone, the veterans and their families have made many sacrifices. Um, there are some meetings that are coming up. It's not Thanksgiving break yet. November 13th is an experienced dyslexia uh opportunity 4 to 6 here in this building. Pre-registration is required and you can look at up the registration link under departments and special education. On November 13th is the district African-American parent advisory council meeting at 6 pm at El Dorado Middle School. November 18th is the PAC meeting. That's the parent advisory committee meeting 5:30 Willow Creek. November 18th is also the CAC meeting, the community advisory committee meeting for special ed at 700 p.m. in 10th center. November 20th is the Measure J meeting at 5:00 here in this very room. And also on November 20th is the DAC meeting uh which is 5:00 at

052Willow Creek Center. And I mentioned these upcoming events because we have elections coming up a year from now. And attending these events is an opportunity for community members who are interested in serving on the board of education to learn about what is happening in the school district, how they might volunteer, how they might um um become more engaged with our school district. And I think it's an important opportunity. So thank you Dr. Clark, >> Madam President and Dr. Clark, if I could just uh put a a spotlight on our student trustee and I'm hoping he'll indulge me of he mentioned it briefly, but the uh scare away hunger event. Could you share a bit more because it is such a fantastic program and I think it it it deserves a broader uh kind of recognition.

053>> Yes. So it was on Halloween night. I the mayor of conquered came gave us a little speech and so each of us I think believe conquered high is the only one who does this out of any of the schools we do for the entire city of conquered we divide up into teams and we try to compete but it's more about trying to raise the most for the community and giving back so we ask for donations and or we ask for cans. We would left a a paper bag the week before at their doorstep and we would ask them to fill it up with cans or donations for families in need and the meals went straight to the food bank and they got delivered on the same day to the food bank. Yeah. And they

054believe that I don't remember the exact number but it was over 20,000 meals were I believe packaged. Yeah. >> Okay. >> Thank you for indulging. >> Oh no, no problem. It's very important. Uh there was also a shout out on our uh Friday letter too with pictures. Dr. Clark. >> No, thank you. Thank you, Madam President. First and foremost, um you know, I'm very very thankful. I I've said it before in this meeting. I'm very thankful for uh Lindor Ortega's leadership um and um really guiding this this you know her side of this process making sure that we can come together and um and reach an agreement. I know it's not final until this board takes action on it but um but very very thankful for um someone who puts kids first and cares about

055kids and has that firsthand experience doing that. So, um, very pleased and looking forward to, um, recognizing or talking about that item, I guess, next. So, um, just bunch of stuff going on in the in the district. I was going to give a report on, um, on scare away hunger, but, uh, I don't think trustee did a much better job than I could have done, but they did um, you know, they did uh, collect more than 12,000 pounds of food and um, over $4,000. So, I just think that's a testament to um to our community. You know, when I came here six years ago, I really talked about making this the destination district. And I think as um as all of our employees, from our administrators, from our teachers, um to our custodians, um our

056our very very talented uh uh uh food service staff, everyone has seen um close to a 25% increase in salary over the last over the over the years. And so I think that that's really big. um full benefits, which in this time when so many um you know, when so many hardworking Americans are losing benefits and having to um you know, pay double the price and things like that and it's just um it's it's going to get worse as as as things continue on. Um, I'm I'm happy for what, you know, for what our employees in the Mount Diablo School District um um you know, have received and um the contribution that they're making. Um my focus is and will always continue to be on our students. Um next next uh meeting we are going

057to be sharing our dashboard data which um again reviews our academics our um um our academics, our attendance, our suspensions, college and career readiness which is which is very important. We had two students sitting in the back of the room from Olympic High School who were doing a um who were doing a report for class here and and I feel bad because they sat through this entire meeting and we never mentioned students really like as a as a regular practice. We usually focus on the adults and things like that and adult adult things. And so talking about refinancing bonds or things like that is not like I'm a I'm a you know 17-year-old students what what does that have to do with me and stuff like that. And so whenever I'm in front of students,

058I want to continue to let them know that every single thing that they see, every single person here is is here for them. And so um our our data continues to be an area of focus that um I'm I'm hoping that um you know, we can continue to focus on and continue to lead in so in so many efforts. When we talk about preparing our students for college and career, um we have the evidence that that's taking place. whether it be um our our college fair um whether it be the many the many many many different programs and pathways that we offer um within this district. How we work extremely hard to not um to not send our students with severe needs out to non-public schools but to keep them in their communities attending the

059schools that were built and designed for them. and really working hard to make sure that we keep these students um in our schools with the supports that they need. And so I'm extremely proud of of the work that we're doing. But again, I'm I'm I'm always going to strive for more um as we have close to 60,000 parents who who send us their best and brightest um to all 55 of our schools. Um, I'm really here to make sure that that we meet what we say we're going to do and that is to prepare them. And I think as you um you know, as you just look at the people who who visit our district, if we're talking about Congressman DS, you know, he came and spent a couple hours with us with our um

060at our county superintendence meeting. Um I also was able to spend a couple of hours with him um as he visited Valley View and and we were in the wood shop together. We went to libraries. we, you know, he brought someone along who did a presentation on the 250th anniversary of America, which we'll be celebrating soon. And then again to see him out at our um at our trades event that we had the other night. Um the state superintendent, Tony Thurman, um you know, a very a very close colleague of mine who um you know, who I work with regularly to have him at our event. Um just little we're little old Mount Diablo, right? And here we are um really just um being the example for so many. And um as I as I

061travel the state and as I get to go um throughout the country um people are amazed at the things that we're doing here in Mount Diablo. It's no secret I share our newsletter to a national um to a national audience and the inquiries that we get on our programs and stuff continue um to come in. And so I really thank this board for their support and for really putting kids first and making sure that all of our efforts are are geared towards our students. Um when we talk about leadership, I think as we um you know as we look at someone who is a is a true leader and who dots every eye, crosses every tea and make sure that um students are at the center of of everything. I don't think I could call

062out a person more deserving than um our own board president in the male. And so with that I have um >> that was pretty smooth. >> And um um and I also in this on this plaque it says um in appreciation to Linda Mayo, president 2025 board of education. Um, we have a beautiful gavvel. We have the Mount Diablo logo. Um, you know, one of my high school jobs was building. I worked at a Morris and a Hera trophy shop. So, I many of these together. And, um, but with that, Linda, I want to present this to you. And yeah, cannot thank you enough for your cannot thank you enough for for your leadership, for your passion, for your knowledge on every single thing that has ever happened in this district in the last two

063or three decades. Um, you're I'm I'm giving you I'm cutting you some slack there. [laughter] Um but but honestly just on behalf of the 29,000 students that we serve the 3,800 employees and of course your um your colleagues there at the dis um this is for you and just a small small small token of our appreciation for your leadership. Thank you very much. >> We had a discussion about this and I said, "Please don't do anything." So, guess what happened? Thank you. >> That concludes my report. I >> I will treasure it very much. Um Oh, and the gavl's removable. Look out. Uh and thank you to my colleagues. It's been a great year. >> Um let's move on to the consented. Oh, we have item uh 13.2. Mr. Shehy. >> Thank you, President Mayo,

064board of trustees, Dr. Clark. Uh tonight I'm I'm pres presenting the review and potential approval of the tenative agreement between the Mount Diablo Education Association and the Mount Diablo Unified School District. Uh we are excited to reach this tentative agreement. I want to thank both the media and MDUSD negotiations team as both teams put in a lot of work to reach this agreement. This agreement continues our commitment to student learning and achievement, fiscal responsibility, positive labor relations, and long-term stability while striving to offer competitive compensation and a positive working environment for all employees. I look forward to continuing the work with media. And with that, I leave this in the hands of the board. >> So, trustees, do you have questions? You ready to make a motion? I move to approve the tenative agreement between

065the Mount Diablo Education Association and Mount Diablo Unified School District. >> I'll second that. We have a motion by Trustee and Zi with a second by Trusteem Mason. Uh are there further comments? Well, I will say thank you to everyone that worked on the negotiations, both media and our team. I know you spent a lot of hours. Um there were positive moments and probably very anxious moments as well. So um but success is the outcome and uh I'm very proud of everyone that was involved. Thank you very much. Anyone else have any comments? Mr. Lawrence, >> I'll save mine till after the vote. >> After the vote. Okay. Uh, Trusty Barrera Oriana, how do you vote? >> Yes. >> Thank you very much. You'll get an A tomorrow in class. [laughter] And the motion is

066adopted on a 500 Z vote. >> Trusty Lawrence. Um, so I I want to thank um Dr. Clark. I want to thank uh the negotiating team on the MDUSD side, but I want to say a a very big thank you to Linda Ortega, the negotiating team on behalf of Media. I want to say thank you to every teacher who has come and spoken before us, who has worn their lovely blue shirts and looked very snazzy in them. Uh the I I have to say the cheers have gotten much better over the years. They're they're very well done and um and and I also just want to wholeheartedly endorse the idea that this is not the end, but rather this is the first step and I think there is much more to be done uh prior

067to the the next round of negotiations and as Dr. Clark said to continue to work to to make this a destination district. And I just want to say a giant thank you. And I think we should make sure to have uh the two negotiating teams take a picture here and and celebrate if we haven't already done that. >> There was one posted. Do you want another one? >> Doesn't hurt now. It's official. >> All right. Go ahead. They wanted a picture of all of us in front of the board. >> You tell us where >> however we want. >> I think we should have a big celebration. >> We can just stand. >> Yeah. >> Well, did you want it in front of the the >> I am not the you know I I'm not

068the uh logistics person. >> Yeah. That's great. >> Yes, we're standing. [laughter] >> Spend enough time together. Come this way, Brian. Well, maybe not. I'm so tall. >> I'm fine. >> Thank you so much. Okay. >> Yeah, of course. >> Yep. All right. We're Thank you, Medadia. Um, we're ready to move on to the consent agenda. uh items listed under the consent agenda are approved by a routine motion, a single motion. There will be no separate discussion of these items. However, any item may be pulled for separate consideration. Do you wish to pull any items? >> Mr. Yes, madam. >> Wait, we we still have a speaker card. Um, Linda Ortega wish to address us on 14.3 >> 30 1430. >> Back to work. [laughter] Yeah, business continues. Um, you know, my heart goes out

069to what's going on with facilities and we do have the three school sites and I was looking at 1430 again my due diligence looking at what's going on with the district. I was concerned because it said that the this item 14 1940 bid notice of completion, but yet I'm I'm getting through my members that they're still waiting for items. So, for example, I I pulled up this one that was shared with me um from Montdale Elementary and it says waiting on material. This is dated 1110 2025. Waiting on material. This week, the contractor has been installing ACP at the two other modernization campuses. Shade Materials is tracking to arrive on time, and the overall schedule remains on track. MDE shade install is slated to start the first week of December. So, I'm confused. Why is

070it posted as being completed and yet there's still items that are not done? my members are waiting and tiles, the shades, all these things should have been included when the contract was written up. So, I I'm just posting this out there and trying to understand why one thing is saying one thing and the other is saying another. I asked several times if I can be part of the information that goes out cuz my members reach out to me. I have no idea. I'm trusting who's in charge is taking care of this. I've asked several times, can I be looped in to these um notices and I still have not been. So, I'm just bringing you bringing this information forward. Thank you. >> Dr. Clark, do you have any suggestions? Should we include this at this

071point in time or bring it back at the next meeting? >> I believe we should include it and if there's a formal question, we're staff will respond to that question. So we have this and we'll send a response. >> So I would make a mo motion that we approve the consent agenda as presented. >> Second. >> So we have a motion by trustee Mason with a second by Trustee Lawrence regarding approval of the consent agenda as presented. Further discussion. Trusty Barrera Ariana. How do you vote? >> Yes. >> Thank you. and the consent agenda is adopted on a vote as presented. Thank you very much. Uh but there will be followup regarding um Mrs. Ortega's item on questions on 1430. We're ready to move to the business items. Um, they are now renumbered. Uh, 17.1.

072Dr. Clark. >> Yes. This is our um um this is our title. This is our um uh school plans for student achievement. And um we do these for um for all of our you know all of our schools who are receiving title one funds. But um there are often times where um where we pick one that is exemplary and we bring to the board to show um to basically like show one. We're showing off here. And so I know I'm putting a putting a little pressure on her. [laughter] That's right. So um so anyway, we're going to have Christina Filios um come up and um and talk about this item. and um and we are we are highlighting Westwood. >> Good evening board. It is my pleasure to highlight Westwood's SIPA plan. Um as you

073know each year based on um CalPAD's reporting, we re-evaluate our ranking for schools eligible for Title One. And um in this past year, uh Westwood's um numbers of free reduced meal percentage u made this school eligible to receive title funding. So in order to receive the funds and um spend them through a schoolwide plan, they need an approved plan through the board and we use the SIPA for that. So tonight I'm bringing forward Westwood's uh plan which is a showcase plan and um do want to thank principal Nancy Clinkner who's here who's worked really hard on this plan along with her educational partners at our site. Westwood was already doing incredible things and really um looking at individual student needs at their school site and I think in this plan have really highlighted how the

074addition of title one funds um is going to benefit their program and expand those offerings. >> Questions, comments? I would make a motion to approve the title one schoolwide program plan for Westwood Elementary School. >> I'll second. >> So, we have a motion by Trustee Mason with a second by Trustee Barrera Oriana regarding uh approval of the title one schoolwide program for Westwood Elementary School. Further discussion. Thank you to everyone at your site, Miss Clinkler. Um, Trusty Barrera Orana, how do you vote? >> Yes. >> Oops. Let me get back to that. And it's adopted on a 500 vote with support from our student trustee. And congratulations. Thank you. >> She didn't even have to present. [laughter] All right. Next item. No, I'm get I'm gonna get her off the hook here. No. Um, next

075next item we have is is review and potential approval of the updated facility use fee structure. And I know we added in a in a um an [clears throat] amendment to to this fee structure. The wrong one was placed in there and so we added an amendment. So, I just want to make sure that all the trustees had a chance to see that. And if you have any questions, Melanie Coslo is here to um to respond to those. >> Madame President, um I wanted to disclose I shared with our general counsel and the superintendent. Um I have for the last six years served as the basketball athletic director for St. John Viani CYO uh basketball, which uh rents the Oakrove gym. And so this uh falls under uh I've been the one to interact with

076MDUSD civic permits. Um but I have one actually have no kid in CIO basketball, but still I managed to uh keep myself as athletic director. So I'm transitioning out this year since my youngest is now in ninth grade. I receive no financial consideration from uh St. John Viani. So I I don't feel like that there's a a conflict of interest. I think I can still impartially uh weigh in here, but if any board member has any objection objection to that, I would certainly uh feel free to hear that, but I wanted to share that information. >> Thank you for your disclosure. >> It's a lifetime appointment. [laughter] >> Feels that way. >> Okay. Uh further information, we're ready for the vote. I move to approve the updated facility use fee structure. >> Second. >> That

077was Mr. McDougall. >> Uh there was a motion by Trustee Mason with a second by Trustee McDougall upon the potential approval of the or upon the updated facility use fee structure. Trusty Barrera Amirana. How do you vote? >> Yes. and the facilities fee structure has been approved on a 5000 vote with support from our student trustee. And I want to acknowledge the uh redesign of the website page which um uh some of my PTA friends feel is much more user friendly. Thank you. Uh, madame president, can you repeat that again so that all the department heads hear that [laughter] >> every school >> out for that web page? >> Okay, not my Well, never mind. I got to be quiet here. We're ready to move on to 17.4. >> Yep. So, um, >> 17.3, I'm

078sorry. >> Yeah. So, so review and potential approval of changes to board policies and administrative regulations um per CSBA recommendations. We're getting close. September 2024 updates. So, um this is just info. Oh, info action. Yeah, we're getting close. >> So, there are three policies um that were presented before. Are you is the board ready to approve these policies? I need a motion. >> Okay. I'll move to approve revisions for BP05106142.92, a new AR of 0510 as presented. >> Second. We have a motion by Trusty Mason with a second by Trustee McDougall uh regarding board policy um 510 6142.92 and a new AR 510. Trustee Barrera Oriana, how do you vote? >> Yes. Thank you very much. We've approved the three policies as presented on a 5000 vote with support from our student trustee, Dr. Clark.

079Madame President, we bring before you this evening um review and potential approval of the initial agreement proposal for the Mount Diablo Education Association Adult Education and Mount Diablo Unified School District initial agreement proposal to media and I have uh Mr. Shehy will come up and present that present those items or present the articles or the process or the date. >> Excellent. Yes. So we're bringing uh tonight we bring both media and MDUSD's initial proposals for upcoming negotiations around this is only so you heard tonight we settled the contract negotiations for the entirety of media with the exception of the adult education teachers who have recently uh joined the unit and so this these negotiations will just be about the inclusion of adult ed teachers into the contract. The district looks forward to a collaborative, professional,

080and efficient negotiations with media. >> Trusty Lawrence, >> and how how many uh teachers would that be? >> I do not have that number, but I can get that to you at a later time. >> Further questions? Both um presentations are there. Trustee Ini, >> I move to approve the initial proposal for Mount Diablo Unified School District and accept the initial proposal from Mount Diablo Education Association Adult Education. >> I'll second that. We have a a motion by trustee and Zwi with a second by trustee Mason uh regarding the um sunshine proposals for adult education and Mount Diablo Unified School District around the adult education program. I didn't say that correctly, but I don't think anybody's going to object. Right. [laughter] Uh, trustee Barrera Oriana, how do you vote? >> Yes. >> Thank you. And

081the motion is adopted on a 500 Z vote with support from our student trustee. Um, thank you. We don't need to extend the meeting or move back to close session. future agenda items. Any new ones? Mr. Lawrence? >> Gonna look at uh our student trustee and our superintendent and and reiterate my request. I would love to see us have updates from our high schools um to have those student reps whether it be quarterly or or as often as we could uh if possible. I think it's so fantastic hearing from you. But in the past, we have had from each of the the high schools a representative come and give a a quick update to the board. And if we are able to do that again, I think that would be a a great representation of

082our schools and all the good things happening. >> Thank you. Anything else? >> Well, if not, I'll adjourn the meeting at 7:30 p.m. Thank you very much everyone for attending.
