hello my name is Marion Chavez today I'm here to talk about my brother Cesar barauna who is enrolled in Ignacio ballet high school at the moment he has been suffering for Bully for over a year and a half now due to that situation of bullying that he has been suffering sorry he has hurt himself physically and mentally he is in a psychiatric hospital we're not allowed to see him at all for how bad he has been going through I do not wish any of this any kid any parent any family to go what we're going through I would like for you guys to understand me and my family and to know what we're going through and help you guys understand that we need your help to get action it matters into the situation that's going

on it is not fair for my brother who is 16 years old who has suffered this much when he has not done anything to anyone my brother was a such a happy kid he he started a chain ready ethnically in front of us we did not notice we did not pay attention to him because we thought it was normal for a teenager to be behaving like this he will keep everything to himself he already talked to us until that last minute that he he had enough of the accident that's when he spoke to my mother he told everything that has been going on at school all the kids that they have some sort of game thing going on in her school they want him to jog and gank he doesn't want to he wants to

stay free out of them and result to that it's because of the bully because he doesn't want to join anything he doesn't want to be part of anything at all they won't leave him alone he's going through a lot of stuff my family and I are going through a lot of stuff which is not fair I would like for you guys to help us and to give us your support and everything that has going on thank you Marion I want you to know that we can't really have a discussion but we hear you and we feel for you and you were very brave to come and share your story thank you thank you thank you would this be loose okay um I've left is of the body is Alejandro Elementary neces Todo Administrations gracias thank

you and you're going to translate for us correct thank you good evening board members and of the school district my name is Lucia I'm the mother of Cesar badona he's an 11th grade student in Ignacio Valley high today I'm here to advocate for my son and for other students that because they are they they're fearful they can't talk my son has been the victim of bullying that on September 6 and I can't hold it anymore he had a crisis and he was evaluated and he was admitted because of all of these the next day I went to the school to talk to the principal but I was notified that he was at his lunch recess I came back after that and they told me that he was in a meeting I explained why I needed

to speak to him but even then I wasn't allowed to so I decided to go and make a police report and after that I reported the district the principal got a hold of me on a Thursday thanks to Mr Alejandro and Hernandez interviewing he sent him a message and that was the only way how he was able able to contact me how is it possible that this is a 9-1-1 case and the school administration didn't have the time to pay attention to the parents even now the school hasn't gotten back to me with a with a follow-up it is obvious that they don't care about my son and his wealth or or his well-being this school needs more attention in the bathroom area since those are the areas where all these things are happening and

the school administration hasn't realized that there are several students that would prefer not to go to the bathroom because they have their their scare because of everything that is going on there these are high school children they are not adult men or adult women these are children do something for them thanks thank you Alexander Dominguez for example draw I just saw that Hold On Foreign important is gracias good evening my name is Alejandra Dominguez and I'm here in support of Lucia who is a personal friend and I also know her son and my son is going to something similar at National Valley and I'm here to speak for them he is afraid of going to the bathrooms because of what had happened there and his charger was stolen and he knows who stoled it but

he didn't want to say anything because he's scared and I told him why don't you go and say something and he told me no I don't care as much about a charger as much as I care about my safety and he didn't want to cause any issues and that's why I'm here today to ask for you guys to do something thank you Alex Hernandez good evening so in Solo duration I'm going to speak in my own language to support the parents when I started members my name Isa foreign [Music] at all women is Rojo Del nombre El paroes is divisions you know foreign Elementary School students Siempre so this is [Music] thank you Alex good evening board members my name is Alex Hernandez I'm a foreign activist for all the schools so the monument Corridor

but today I'm here as I've been buying from Oak Grove Middle homes and now Ignacio Valley high school but today I'm here as a father not uh not as a member of the committee I'm here to support my friends and their kids at Ignacio Valley um I don't understand how the school administration can make time for a case that has been sent to 9-1-1 and then they tell them that they are having lunch or they're in a meeting there is one principal and two Vice principals I'm sure one of them would have had the time to attend these parents and the same with the bathrooms the bathrooms need more attention there's a lot of things that happen in there and I know that we are short staffed but we need to pay more attention to

those areas because there's where where all kinds of things happen like smoking the students are doing drugs they're drinking and they're also selling drugs in those bathrooms so and all kinds of threats happening there and the principle I don't understand we talked to the principal and ask him why there's this division again from red and blue and blue the last principle I don't remember his name but he had said that there were not going to be any more blue or red uh discussion sense if he or anything like that then he will talk to the parents of those children that were talking about division and and that worked so I'm here looking for your advice and for the support and for all the schools on the monument Corridor on Friday the parents at meron Hall

at Meadow homes call me to tell me how is it possible that students from high school were threatening elementary school children but what I liked about that school is that the principal paid attention to it immediately and he alerted the police and alerted the parents the same happens at Oak Grove the principal there does the same thing and anytime that there's some kind of fight he takes charge and he calls the parties that are needed and the principal should be available for the parents and I think the principal at Ignacio Valley needs more training about that and he has to pay attention to the parents that have cases like this and not wait until I chill until a child has been hurt or is hospitalized to take action thank you Linda Ortega is up for

this or is this for communications it's kind of hard to come back come from that my heart good evening trustees Dr Clark members of the audience my name is Linda Ortega I am the Medea vice president I am here this evening to report that the contract that was signed after a long bargaining day and into the following morning on March that long day that some of us attended between Medea and the mdusd is completed and downloaded onto our website I want to thank everyone who participated in the review of the contract and preparing it for the final publication I also want to thank our members our media members for the continued patience as we bargain the new contract and I want to thank the members of our communities for supporting our media members during these

past few years however on another note as the Medea grievance chair yes I wear many hats I would like to report to the school board that I have received over 25 class size grievances since September 7th and I'm still receiving them every day for the members of the community what does that mean it means that there are many classrooms that are over the class size maximums our teachers are working hard every day they come in with their heart to share with their students and be prepared however with the class sizes the way they are it's very difficult to give every student the attention they deserve and so when I share with you about these grievances this is a very disturbing since tonight you will hear about the 20 the 2021 and 22 on audited actuals

and I hear that new money that is coming from the state to the school district so my question to you the trustees is how will this money be spent will our students benefit directly from this new money or will it be spent to hire more District administrators our classes are suffering our students are suffering and as vice president I hear from many of our members and how they do not have the supplies or support they need to teach our schools our students our members need to know that you will spend this money wisely and that it will benefit our students thank you thank you Gabriella I'm gonna mess up your last name Gabriella [Laughter] so good evening uh trustee's superintendent and guest my name is Gabriela chevarria my son is a second grade teacher second

grade student rather I was just thinking about the teachers uh before me um at Holbrook Language Academy I wanted to start by comments by sharing that my my personal experience with the collapsing of the second grade classes before I go into that know that my son does not do well with change at all because IEP includes that he needs plenty of notice and we need to prep him for any change that happens on Thursday August 31st at 5 30 PM we received a post on parent Square letting us know that second grade classes were collapsing no previous notice was received we did not have an opportunity to discuss this or have many opportunities to ask questions of anyone about this change this news was shocking not only that but the change was going to happen

the following Tuesday leaving only one work day for the change to occur this brought about confusion as to what as that was the only message we received it did not mention anything about switching classes which was new for my son I did not mention how this would occur would they how they would Stitch classes or where students would leave their stuff during the classroom change the message that went out on Thursday evening was the weekend before it was the Thursday before Labor Day weekend well most kids were enjoying their three-day weekend my son was nervous the entire weekend on the upcoming changes he asked me how the change would occur when they were transfer classes where he would leave us stuff unfortunately I didn't have any answers to him because I was not given any

of that information sadly I know this wasn't the worst case scenario some students were going to have a new teacher all around and some students were even asked to leave the school I was shocked that schools would turn away students in an environment like this on the second day of class with these changes I asked my son's new teacher if she had read his ipe IEP she said she hadn't had a chance I don't blame her at all as one workday is not enough to accommodate 10 additional kids she did not know what my son was going through I continue to ask myself why this was done I know that the CBA and the CDE allows for a maximum of 31 students in second grade before being penalized however just because you can do something

doesn't necessarily mean that you should I'm assuming the maximum number of 31 did not take into consideration our current environment all these students were introduced to kindergarten in a virtual setting many of them most of them did not physically attend the school until first grade there was learning loss because of the circumstances additionally this is a dual immersion school they're not only learning the basics but also learning a different language which one would think would require additional resources or would benefit or would benefit from having smaller class sizes so that teachers could provide extra assistance to students I know this cannot be a matter of funding is there a significant educational Investments for the 22-23 year among other funds K-12 districts will receive 7.9 billion dollars in prop 98 funds for learning loss there's also

additional funding for Ada I know my time's up I want to end on one note parents the message parent Square sent ended by saying we continue to be committed to dual language education and high academic achievement unfortunately the actions that were taken and collapsing the classes shows just the opposite so I asked that the board please reconsider the decision made by Miss Margie callback uh took collapse of second grade classes at Holbrook Language Academy thank you got Jacobs good evening I'm not nearly as articulate as my other Holbrook parent over here um I've got I've got two messages uh one is terrific I've been a Holbrook parent I've got a second grader for you know just over two years and we love it when we sold our house we could have moved to Lafayette we

stayed in the district because we want our little boy up to grow up to be bilingual and to go to school with a diverse community of students um that was important to us we are committed to the school is the district committed to the program is the question I have we had 22 22 and 22 in our three cohorts when the district Shuffle Up happened uh they kicked three kids out of the school who did nothing wrong and they put the other the uh other cohort they split it up and now there's 31 in each class and there's not even enough hooks for the backpacks outside the classroom this isn't about buying another hook for the classrooms but it's about uh does does the board support bilingual Communication in building a really good uh program

that the whole District can be proud of I hope you do um one of the concerns I have is that there appears to be a condition for kids to get to matriculate in after first grade that they have to have previous experience in a dual immersion program but it seems to me and I'm just a layperson you guys are the Educators it seems to me that there has to be a way to assess capable kids that have dual language experience and and capabilities to be able to matriculate in because to go from three cohorts in kindergarten to two cohorts in second grade this is an unsustainable trajectory and I want to stay here for another what seven years till he gets graduates eighth grade so keep supporting our school and um don't kick kids out

that haven't done anything wrong it really uh is shocking to them and I know kids are resilient but it's also shocking to the families so take that into consideration thank you thank you a speaker card jofina Whitfield yes it's joffria I think you tell me every time I'm going to write it phonetically here so I'll remember don't worry you'll see me in the good evening to Dr Clark on the board I'm here once again on behalf of Elementary instrumental music I wanted to share with you some data that was done from a survey conducted by one poll on behalf of the Guitar Center from June 6th to June 8th 2022 with a panel of general population Americans and 1 000 who've played instruments how do families feel about instrumental music eight in ten want their

child to learn an instrument one in five parents say their child wants to be a musician over half 55 percent of parents think music education should be prioritized in schools and finally 82 percent of parents want their child to learn to play a musical instrument thank you for your time thank you okay that concludes our public comment now it's time for communications District organizations at regular board meetings a single spokesperson of each organ we recognized District organization and make a brief presentation items are limited to those that are informational I do not see any cards okay that will take us to 10.1 recognitions and resolutions 10.1 review and potential approval of resolution 22-2310 recognizing October as lesbian gay bisexual transgender queer and questioning month Dr Clark great thank you madam president I have here resolution

deferred maintenance we know that over the last few years we really haven't kept up with a lot of the maintenance that our sites need and this is very important including for technology and the second one is something that the board approved back in June of this year it has to do with both the Medea and the mudspa hiring and retention bonuses and we want to make sure that we are clearly committing those funds moving forward thank you Madam president I moved to approve resolution 2223-17 designating certain General funds as committed fund balance thank you we have a motion in a second I don't see any questions okay trustee Nava Flores yes and that passes five plus one and 10.9 reviewing potential approval of resolution 22-23-18 proclaiming September 15 2022 through October 15 2022 as Hispanic

Heritage Month Dr Clark well luckily we have this on the agenda tonight we only have about uh six more hours until tomorrow so whereas the month of September 15th to October 15th was designated as Hispanic heritage months by the United States Congress in 1988 and whereas the huge and significant impact of Hispanic and Latino cultures in their centuries-old Traditions are manifested in the achievements customs and laws of this state and Nation and now therefore be it resolved that the Mount Diablo Unified School District governing board hereby recognizes honors and celebrates the many contributions Heritage and history of Hispanics Latinos Latinas and latinx people during our annual commemoration and proclamation of Hispanic Heritage Month and encourages all schools and classrooms to commemorate this occasion with appropriate instructional materials in a manner appropriate with coveted regulations Etc

okay trust you know the floors go right ahead Buenas that is the united states recognizes September 15 through October 15th as Hispanic Heritage Month where we acknowledge our Hispanic and latinous students and Educators where we also recognize both migrant and native born Hispanics in Latinos in instructions to understand diversity in multiplicity of our accomplishments and contributions to the world we celebrate our different nations Heritage cultures languages and histories mathematics Technologies having a quality and inclusive education is having access to knowledge and educating our people's history where we come from and our success and struggles and sacrifices having access to resources and opportunities that will help support our students and guide them to and through their College and Career interest starts at our schools we must promote and strongly encourage our bilingual students to continue to

communicate in their native languages such as also advocating in the needs for the students oh well okay and honoring our cultures and contributions schools climates must be welcoming and accepting and celebrating our diverse cultures we can do this by again having more communication with our bilingual families and then again this brings it back to the importance of having opportunities and resources specifically for our communities having them aware of them and creating a communication again with our bilingual communities and the things that benefit them for a various school and educational opportunities this will have a deeper appreciation towards our community and have create a supporting and encouraging environment district-wide thank you thank you would you like to make the motion Madam president I move to approve Hispanic Heritage Month under the resolution of proclaiming September 15

0392022 and October 15 2022. thank you I'll second any other comments yes I do I just wanna I just want to thank again trustee Nava Flores for your eloquence in in both languages um to recognize this month uh this heritage month and to recognize that um in part of our resolution tonight uh that over a quarter of the population of our district our students of Hispanic or Latino origin um and so that means that um it's even more important for us to be really uh recognizing and being inclusive of the cultures and languages that that includes I'm uh I'm proud to report that in a recent PTSA meeting at Ignacio Valley High there was a translator provided as we've been really trying to do um always at that school um but for the first time

there were far more Spanish speakers than English speakers and so the meeting was held in Spanish with the translation into English and I think we are in a place in this District where in a lot of cases we'll be able to hold our meetings in all different languages with translation into more and more languages and so I think we've made some progress in the last few years in this area in our district with things like tools like parent square and extra investments in translation and there's so much more to do but um I'm excited about the types of things that that we're moving forward with in this District in terms of creating welcoming inclusive schools for all of our kids thank you okay Nava Flores yes and that passes five plus one thank you uh

public employees appointment I'll just turn this over to you yeah we're going to have um Dr scudero and he is going to do the next two items or just this next one next two all right foreign resources department is bringing for the board's review and potential approval the appointment of Courtney Peterson as the vice principal at El Dorado Middle School Courtney is an 18-year educator in Alameda County having served students in Fremont New Haven and San Lorenzo school districts in that span of time she holds a bachelor degree in physical education and health Courtney is a proud Bay area native and born and raised in Fremont and has been a resident of Concord since 2006. she has two children who attended School in mdusd and she's not working she can be found at local amusement

parks exploring San Francisco watching sporting events and tending to her plants with that I leave this appointment in the hands of the board thank you board members Madam president I moved the board approved the apartment appointment of Courtney Peterson for the position of vice principal at El Dorado Middle School thank you second okay we have a motion and a second Christina the floors yes looks like you have some guests here that you can introduce I just wanted to tell my kids I love you go for your dreams even when you have kids early hopefully you won't keep going for your dreams professionally uh thank you board um yeah this is a dream of mine thank you very much thank you Dr skadero the human resources department is bringing for the board's review and potential approval

the appointment of Carl Davis as the Director of facilities and bonds Carl taught students in Middle High and Adult School in English social studies math and physical education for several several years after which he served as a Middle School site administrator for two years Carl earned a bachelor's degree in political science and a master's degree in teaching Carl was raised in the East Bay and is happy that life has brought his family back to the best of the many places he has worked with that I leave this appointment in the hands of the board thank you board members I'll move that the board approve um Carl Davis's appointment as director of facilities and bonds thank you second you have a motion and a second Christina the Flores yes you'd like to come on up thank

you board members I appreciate your not asking why an English teacher should be your facilities director I would mention for your own comfort that I've been building schools in California for the last four years and have many more years than that as a construction manager and project manager behind me I look forward to helping this district with its schools its School construction program and its Bond program thank you thank you and welcome hey 12.0 reports and information review the actual actual valuation report of retiree Health liabilities as of June 30th 2022 under government Accounting Standards Board or gasp 74.75 that sounds like a thrilling report doctor Clark we have Mr Williams who is our internal auditor and he is going to um present or be available for questions so the floor is yours sir thank

you um so in uh in March of this year we had um photo compensation come in and do a presentation on the district's um opeb liability so this is just an update to that report um during the fiscal year there was a decrease in that total liability amount um it decreased by uh 22 million dollars from 220 million to 198 as of June 30th of this year um and the reason is because um there was an increase in um in municipal bonds rates um that number actually decreased by 3.5 percent during the year so they took that percentage increase and uh discounted the liability from last year to this year so that's why there was a huge decrease in that liability um everything else stayed the same in terms of that the number of um

retired reasons that we have um and the number of employees that we currently have so there was a huge change that happened during the year so the numbers did not really change that much just the um the interest rate just due to market conditions changed so that's why um the liability went down so um if there's any other questions on that I'm I'm here to answer right oh yeah this is good this is good for the district yeah it's a lower liability for the district for the fiscal year so that's um do any board members have questions well thank you for your time no action there right yeah that is very good news yes thank you yes okay board reports I think um we'll shake it up and start with trustee McFerrin is that all

right um all right um good evening everyone um I've been to a couple of my favorite kind of regular meetings um I went to the budget advisory Council um meeting on August 31st um and we did have kind of some new people in attendance kind of asking some good questions around um at class sizes and and um changes in teachers um kind of things of that nature that we've been receiving some feedback on um and um so that was an interesting discussion and I think helpful um I went to the um the CAC meeting on last uh Tuesday the 6th and um I would like everyone to to know that those are great meetings to go to they're open to the public that group really um makes tremendous efforts and um to a really great

outcome of keeping those meetings really accessible and they're in a hybrid format so people can come in in person or also watch and participate over Zoom um and they will be holding a candidate forum for their next meeting for um some of our school board positions and so that'll be on October 4th and I encourage anyone who's interested to come either in person or um or attend via Zoom it's really easy to find information about CAC just by um typing into the search bar on the district website um and then I also want to say that I'm very much looking forward to going to the Battle of the Bands this um Saturday it's going to be um I was trying to look up the information I thank you five to eight at Concord Heights at

Concord highers at Dave Brubeck Park J Brubeck Park right next door um I wanted to go last year and I think I had something that I didn't want to do that I had to do instead so I'm very glad that I get to attend this year and I'm looking forward to it and that's all I have to share thank you vice president zawe um I just want to start by thanking Dr Clark and thanking Dr Francis and everyone who put I don't think Dr Clark put any work he just like said we could do it but Dr Francis and parent volunteers and everyone who put in such a an amazing effort to hosting the districts I already forgot the name of it but I'll call it the cookout for black parents black families students um

because it was a cookout the food was amazing um but I just I said it last time but I just want to reiterate the point that when you find yourself such a significant literal minority in this community in the mdusd community it can't be um like we can't take for granted that importance of having the opportunity to be in community with as parents with other parents who may have the same experiences as you or similar and not feeling like you're on an island um at your own school and so it was very it was a very inspiring evening it was an evening where you all know well many of you may not know I'm incredibly shy um I am incredibly shy and but it was an opportunity for me to to pretend I'm not and

just say hi to people um as another parent um so it was just great to meet people great to see the faces great to see the history in our in that room of um black leadership from this District um and it is just one step in us making a change and making a difference um for our students and for our parents um so I did attend that two weeks ago so that's my thing last night I'll send in my other thing I want to share his last and I got to be a parent again so it's this year feels better I feel like I'm being more just a parent getting to show up into spaces as a parent but um to go to the um my daughter's schools choir concert um and well it had

a name Cafe so there was food it was a potluck and it's probably all the different choirs at school came together each of them singing a few songs and it was just lovely that in how many days that we had of school 20 some odd days I think it just sounds so lovely um so it was good again and another way to fill part of a community so I appreciate that about our school's offering things like that and it's nice to be back in person to do that thank you Mayo yes thank you good evening everybody um I and Miss McFerrin attend many of the same meetings so we repeat each other I was at the August 31st budget advisory meeting and she's already shared about the special accomplishments of our special ed CAC committee

they are presenting a series of speakers uh and this week this month's speaker was Jessica posos who's the assistant director of special education and mental health and the 504 and IEP process was highlighted and she shared the tiered levels of intervention available to students to mitigate symptoms they in order to access their academics in a school environment and the supports are based on students need the um Powerpoints and information from each of these speaker series presentations can be found on the school district's website under special education and CAC and also I want to give a shout out to the CAC for um what do I want to say improving the Facebook page where there is a detailed report of it's almost the minutes of the meeting as well as links to the presentations so that

is at of course facebook.com mdusd dot Community advisory committee so there are resources there and it's very informative for folks to look at those and even when you don't have a special education student often the information can help you with your own child um the 17 on September 13th I attended the parent advisory committee uh Dr Clark and Miss Sachs welcomed uh our parents to this first meeting of the year and um worked with the participants to gain information about future topics and uh get some feedback about the school reopening experiences I'm looking forward to the September 22nd teacher of the year event to be held at the Leisure theater in Walnut Creek and although I will miss the dinner environment uh I'm excited because this particular venue um the tickets are at least half

in cost and as compared to uh previous years and I'm hoping that there will be more participation from our community and come out in support of our Mount Diablo teachers and nominees my last comment is the Contra Costa County science and engineering Fair will be held March 10th 9th 10th and 11th at Los Medanos College and this year we are looking for to be held in person on the Los Medanos campus so you're going to hear about this experience over time for me scientists grades 7 through 12 may enter this competition parents or advisors or teachers may be the adult sponsor projects for students will be due March 3rd 2023 and there are some additional earlier deadlines that students must meet information will be available on the website ba Dash l-e-e-d-s Dot uh org backslash

science fair and students can gather information there get ideas about projects that they might want to uh try out and obtain all of the entry information and if you're interested as an adult either as a parent of a prospective student participant or just because you love science and want to see what the quality of the uh work it that is done by the students you can visit the website and see the April 2022 awardees and how well they did at the California State Fair and the International Fair where several of our students won awards internationally so thank you nice okay trustee count thank you um so I got to do some fun things the last couple weeks as well um the north gate music program had their march-a-thon where they marched through the neighborhood um

very popular fun event I was one of those parent volunteers on a bicycle um so it was really great to see how much the community supports our schools and gets excited little kids getting to watch um the older kids playing their instruments out there in the streets um I also attended the monument impact um Gala fundraiser event where two of our Ignacio Valley students were recognized for their leadership and and commitment to community service in their community um always wonderful to see that and Monument impact makes such a difference um for um for especially our immigrant Community um and uh in helping people start small businesses um and uh and get all the resources they need uh in in our community um I had the chance to visit our adult education um both the job

center as well as the um Cafe there that's run by the adults with disabilities they have really good all kinds of flavors of um coffee there and so I highly recommend I'd have to go back to try all the other flavors that they have I think I had a Cubano it was really good and they did a great job um uh I also um uh have attended some meetings and volunteering in support of the Walnut Creek measure o which intersects with our schools in that it funds um things like uh crossing guards for our school students and increased Library hours for the community so I'm really excited about the possibility of our community investing in uh in those kinds of things in in addition to facilities throughout the city of Walnut Creek um also was

invited out and attended a meeting with teachers and with Dr Clark at Walnut Acres around the issue of class distribution which we also heard about tonight from what was happening in Holbrook it's certainly something that I'm very concerned about and would like to make sure that moving forward we figure out how to have the least disruptive um beginning of school year for in particular for our elementary school students throughout the district and I think there are many ways that we can talk about how we can do better with that um you know whether it's with the teacher contract with the processes with the timelines um so I think over the course of this year that's um you know something that I'm hoping we're able to work in partnership with our employee groups on um and

I especially feel that in the case of Holbrook it's um uh it was extremely disappointing to see us have children need to be moved out of a program that we have really invested in the Dual language program which I highly support so I look forward to seeing what Solutions we can we can come to on that topic um coming up I'm excited about Battle of the Bands um there's also October 1st the break a sweat run for Education that is run by a non-profit called yours humanly in partnership with our district-wide Education Foundation um so come on out uh the morning of October 1st to Heather Farm Park you can get information at break a sweat dot run and you come out and see the Northgate madrigals are going to be singing the National Anthem

the Ignacio Valley High cheer team is performing there are many local parent-run businesses that will be there and you can join a team so there's a team that's the that's the Education Foundation you can click and join that team but a number of our schools are starting to create teams too so far on the website I've seen Monty Gardens Sequoia and and yv wolf pack is the name of their team and I know lots of times we have many more schools than that so get out there create your team and remember you don't have to run and you don't have to be like an amazing racer A lot of people walk and push a stroller and it's just so much fun to get together with people from all across the district um lastly just wanted

to mention something that I've discovered again is a resource out there for us when we keep hearing from people about fourth grade music and what are we going to do about that I really like to think in a much more big picture how are we moving forward as a school district um on all of our Visual and Performing Arts plans for all of our kids and all of our grade levels and just to point out there's an organization called create California that helps school districts to create a district-wide strategic vapa plan and so I hope to see this as part of our our board workshops or plans going forward in some way what's exciting about that is that they help you create the plan in a way that's not just you know just employee groups

talking in inwardly within our district it's also required required to have Community Arts Partners at the table in the planning process because right now we have some amazing Community Arts groups we have Community Civic Arts we have Diablo ballet ballet footballer go we have organizations like the Leisure Foundation that all have been doing things in our school district but it's been piecemeal you know one school or another it changes year to year and I think there's so much that we can do if we get everyone to the table to really look at the whole picture so I'm very hopeful about what that could mean and and how much more we could provide for all Visual and Performing Arts in our community thanks thank you trustee Nava Flores good afternoon everyone um today I'll be speaking

on a series of topics all related to a similar issue but before I get started I do want to also again acknowledge that September is suicide prevention month and encourage all students um to well encourage um and encourage all students that if they are in need they are eligible or able to take a mental health day off again these are excused absences and these are valid absences if you are in need of a break or a time to just step away and get yourself together and again be prepared for the academic setting that you are in you are able to take a mental health day off um last last last uh last board meeting we um discussed the the bathroom issue specifically on the menstrual product dispensers um I wanna let everybody know that I

did discuss this with the principal at my school with Dr McCain and we took a a campus tour where we toured all the restrooms um the the issue regarding with this the closure of specific restrooms again not only happening at Mount Diablo high school but at other school sites as well we discussed why this is an issue and an urgency to why this problem needs to be addressed and because we were um touring the touring the school campus um during break hour or during our break time there were students that were also able to put in their perspective to um to Dr McCain and that was really wonderful we sat down and we discussed a potential solution and again we did we did a agree on having the menstrual products dispensers being monitored and being

implemented with Integrity um so I did want to discuss on that the next thing that I wanted to speak up about was the impact of the the impact on the student in regards to the lack of College and Career counselors specifically at Mount Diablo High School now it I've also um no sorry sorry about that um the importance of a college and career counselor is more than just a designated person in charge of speaking up for college and career opportunities and having an expertise that is knowledgeable is and specifically in a college and career opportunities and again knowledgeable in um in in Opportunities such as when to register for the s.a.t for the act when it is time to register for the AP exam and things like that also having an expertise in how a

college application is due what factors you should consider applying for financial aid or Alternatives such as applying for the dreams act under the under California and having somebody designated specifically for in that in those in in that topic we have the we have the support and we have the opportunity to have somebody guide us through um guide us through call our college application and again through graduation um and this specifically has impacted Mount because we do not have a college and career counselor and I want to also know um what the what the situation is on is on this um how we are moving forward from this and what alternatives are we doing district-wide but also as a school um with that in mind I also want to speak up about the teacher shortage and

how it's impacting students um like many uh many people many have spoke spoken up about um classes are classes have surpassed the maximum and it is first handily impacting the students um at Mount specifically um we are the teacher shortage is really impacting our students in which students are having long-term substitutes but with no um with no learning plan and that impacts the students because we are in a classroom where learning isn't being isn't happening and again this is an issue for students for students education because they were being held back being held back from opportunities and precious knowledge that they have the right to to obtain um and within that I also want to also um let you all know that I'm getting the student advisory committee up and running so that I can

also have more um more voice specifically from school sites and how the issues around the district but also at school at the schools themselves are impacting the lives of the students and their education um and then I also just want to appreciate everybody that was at the black family Extravaganza I was there um as well and it was a beautiful event and a much needed event and like um trusting in their weeks and they mentioned in having a community in support and into in support and recognition of our students and our communities in our school we can have success and by encouraging and supporting again like our students and their education culturally and socially thank you thank you I will be brief I um went to the dragon Cafe which is in the afternoon and

they had great ices I got a watermelon icy and a bracelet from our Bridge students that was really cool they were doing a great job running their little cafe over there I went to the Shore Acres back to school night huge turnout the parents did a great job of having food they had food trucks out front and other options for kids parents so they could eat right before they went to their kids class I went to Java with Janice which is coffee with the principal of Rio Vista and she had a few parents show up and um very excited to have their kids back on a regular basis in person one parent who was new to the school and was couldn't say anything but good things about their experience at Rio Vista so far um

I went to Bel Air's back to school night last night which is why I couldn't go to the PAC again very good turnout I always like to go to Bel Air that's where I started on this journey in kindergarten it was a new school then it wasn't an old school but um they consider me still a Bel Air bear so I like to go there and I would just like to um say that um trustee McFerrin talked about the CAC which I couldn't come to the whole meeting because I had other stuff going on but I was able to pop on the beginning hear the presentation so it's nice that they're kind of doing it hybrid like that so you can still if you're a parent you're cooking at home and you just want to

listen to what's going on you can do that while you take care of your family and um that was pretty much it for me for since the last meeting and we'll turn it over to you Dr Clark thank you definitely um you guys are keeping very busy out there lots of stuff going on so exciting to be back yeah well good well hopefully my um my report contributes to that to that good feeling um go forward here so first um I always like to review our our lcap goals and and really what we are committed to as a as a district as a team of Educators and adults who are are taking care of young people um you know all students will receive a high quality education and a safe and welcoming environment um high

quality culturally proficient and responsive staff will provide engaging instruction respectful of all students backgrounds and parents families and Community will be informed engaged and empowered as partners with mdusd to all support student learning and goal for our Focus Scholars specifically are black and African-American students Foster Youth and students experiencing homelessness will experience culturally responsive practices and instruction with high expectations equal access to educational opportunities within a supportive educational environment so again that those are our goals that's what we are striving towards that we reach each and every one of those goals same thing but in a nice colorful um you know colored picture here um at the bottom we want to make sure that we stretch educational equity which means that each and every student within our district when they exit our organization they should

be able to attend the college or university or pursue the career of their dreams and their family's dreams and it's our it's our responsibility to prepare them for that and we're going to do that by accelerating learning that means that grade level standards are the floor and we're going to teach grade level standards and above but not below that and we're going to do that in a high quality and culturally responsive way and then of course we're going to focus on the social emotional learning of all of our students and families and employees and our parent family and communities are partners and if we do that we have Equity we have Unity which is going to create opportunity for all students so a couple of announcements I'd like to make first of all on on

Thursday September 22nd I know trustee Mayo mentioned this we are going to be at the Leisure Center in Walnut Creek um um and and we are going to um celebrate our our teacher of the year um finalists we are so lucky to have um we had Catalina uh Gallo from Mount Diablo high school as as a um as one of our Mount Diablo teacher of the years but then also our own Mount Diablo high school and Natasha Paul is a finalist and you see there at the and the pictures there's four finalists throughout the all of Contra Costa County and one of our Mount Diablo High teachers is one of the four and so we're hoping um we're hoping that evening to be celebrating um her accomplishments and regardless she's the winner in our eyes

and I'm sure she's a winner in the eyes of her students um you know it's amazing what a what a week does right so last week we were all we were all um you know suffering from the heat it's been very helpful that our our County um County office and and County Health uh put out these guidelines I know that that um regardless of guidelines when it's hot it's hot but at least we have some guidelines to sort of um you know walk us through some of the some of the activities and um so again these were these were provided on our um through parent Square on our Friday letter and these were sent out to all staff um and and hopefully families got those through our website and through parent Square um but you

know we are going through climate change and so um you know there we had you know smoke not long ago where schools you know were were affected um you know we there was an earthquake last night in in Santa Rosa we had you know temperatures of 113 degrees last week and pretty soon we're going to be dealing with cold weather and so we as a as a community as a state as a district we need we need to prepare for these events we can't just shut school down every single time one of these events happen we have to find ways that we can ensure that we can keep everyone safe and comfortable and and still provide the services that we are responsible for doing so these these guidelines on hot weather are you know are

going to be helpful we have guidelines on smoke um you know we're going to be hearing presentations in a little while around other safety mechanisms that we're implementing throughout the district but um but just thank goodness that we we have a a bit of a break from the Heat and it's much more comfortable outside just kind of going back to the beginning of school you know how can you how can you not just appreciate this picture these are young students at um Cambridge Elementary that all receive backpacks and we want to thank the the family Giving Tree and also the Shane Company for their for their support and donations in this endeavor but um you know seeing seeing these little people with their backpacks is always so cute because sometimes they need to grow into

the backpacks and then also um just in in line with a lot of the work that we're doing district-wide to really instill standards and expectations of Excellence throughout every one of our classrooms not only do we have teachers who are participating in trainings we also have our principals who are participating in training and here we have a few pictures of our some of Prince our principal teams visiting multiple classrooms to observe math lessons and really making sure that grade level standards are being taught and really training our principles on how to recognize those and to be able to support their teams in ensuring that those are happening in each and every classroom throughout each day and of course as I said at the beginning the grade level standard is the floor obviously if we have

students who are ready to exceed those standards then let's continue to push them forward and drill down even deeper in in our curriculum and instruction um here's another picture and it just so happened to be our um our Pleasant Hill uh principles and uh slice of Martinez who who went on this visit um at Valhalla Elementary School and here's just another picture of another cohort of um principals and other support folks who are um visiting I believe this was Fair Oaks Elementary and they're visiting math lessons there so just if you focus on what the students are doing I mean here you have students in groups working on their um you know working on their Chromebooks um there you know you have students in groups working with math math manipulatives and here you have students

in groups again embracing technology and other students using just traditional um uh pencil paper but I also see manipulatives on the on the table there so this is very exciting work that's taken place throughout our throughout our district um this is a picture of 76 very excited middle school students at the robotics club and so we can only imagine you know just um the amount of work that takes to um to lead that club and we have a you know we have a a teacher that is leading that group and um you know and clearly she is committed to our to our students and ensuring that they have opportunities outside of the school day and outside of their regular day to do something that they um are passionate about and this is Robotics and so

clearly there's no shortage of that and it's good to see the um diversity of the students in this picture who are engaging in in robotics this was a neat picture that we pulled down from this is coming from Pine Hollow Middle School and what this is is basically the resumes of the adults on campus and and I know it's kind of small here to see but um you know you'll see the years of um you know of of experience on this campus you'll see that that these um teachers have have worked at 48 different School sites um the yellow paper on the bottom where they where they recognize the office team that there's three Bachelor degrees and several master's degrees in that office and and just so on and so on I was just really

impressed by the wealth of knowledge of the adults at at Pine Hollow who are serving those middle school students there and then um you know many of our schools are going through back to school nights and and I just have to tell the the families out there that as a you know as a as a past teacher I really never had an issue talking in front of kids I could just go on and on but when those parents come and sit and sit in the classrooms um we all get kind of tongue-tied as we you know have to have to now um you know talk to adults and talk to parents and now that I don't work directly with kids anymore it's much easier but when I worked with students it was always always a

little nerve-wracking talking to a room full of parents but it looks as these two teachers um at Pine Hollow have have mastered that so again um I think we've heard from several board members and and whatnot about attending different back to school nights and and and things but those are happening and that's really where parents are able to come and visit their students classrooms and hear about the um the activities for the year and the goals and and and you know I don't want to say necessarily rules but just procedures that parents can use to be to be partners with us with educating educating our students we are very happy in October and so we're you know well a month a month ahead of this to um you know to put out to save the

date for our mdusd college fair um we are back in person unfortunately we've had to hold this on on zoom over the last couple years but we will be at the Ignacio Valley high school and it has opened up it is open to all students of mdusd and their and their families and also our adult school programs um so please save the date and um you know again you know we want to prepare all of our students for College and Career and um you know we we do lots of of career activities as well but this specific night will be dedicated towards um towards the college process um speaking of the college process we had some of our Mount Diablo High School alumni come back and talk to current seniors and just very impressive these

five ex-mount Diablo high school students you see we have two attending Cal to attending DBC and one attending UCLA and just just to kind of put it in perspective last year UCLA had 149 000 applicants and the University of California Berkeley had a hundred and twelve thousand applicants and so very proud that um you know some of our Mount Diablo alumni are are attending those prestigious universities and so um and again our our students who are taking advantage of DVC which is just right across the basically right across the road from Mount Diablo high school I just um and just so huh no I know Mount Diablo High School is the just the hop skip and jump away from DBC right I mean you don't have to like leave the state or anything but yeah

College Park is next door to BBC but I'm impressed that that these students um came back to share their experiences with uh with um current seniors in their particular Academy so kudos to um to these students and always very proud of of what um you know what the adults in this District produce in terms of young people who who exit our um our organization this is a um this is a picture of the wellness room in uh Ygnacio Valley High School we have it this year we you know we've we've transitioned to this to the staff here we have um someone from public health we have a Social Work intern there we also have an upward um bound person from from DVC and again just just very responsive to the needs of of our students

over at yv we actually have um um wellness centers in all of our high schools and pushing them out to the middle schools as well but um just very excited that our students have a place where they can go and be supported and go and get that extra support from um from from the social workers that we've hired this year and also from mft interns and just so many people that are um you know around to support to support our students outside the classrooms also just some high school happenings um you know you see I mean you know the pictures don't do it justice but these are high school students and you have some students who are working on an engineering project on the left and you ask some students who are engaging in outdoor

reading and and you know that is a classroom those are those are high school students and so um you know they really seemed and engaged in that text and are um you know clearly working very hard also just other High School happenings on the left we have College Park College Park was highlighted by the Contra Costa times and it was a it was a story just about how thrilled our students are to be back at school after you know missing an entire year and coming back last year with the many challenges that we all faced but um so this article was just nothing but complementary of of the students and their experiences and the students were just sharing how excited they are to be back um you know back in school full time every day

without you know the restrictions of mass and testing and distance learning and things of that nature and then you know we have uh we have our our Northgate volleyball team who won a tournament out in out in Deer Valley and they're celebrating that other High School happenings Battle of the Bands there's um as trustee Town shared earlier about the the Northgate Blitz or whatnot what was it the band blitz march-a-thon so there they are marching down the marching down the street there and um and the battle of the band Saturday this Saturday five to eight at the park next door to um to Concord High School so so again just just very very excited about what has taken place over the last few weeks of of school we have 28 000 students in the in

the district we have 53 53 schools we have close to 3 000 employees and um and we provide a very good service for our students and for our communities do we have challenges absolutely um you know these are extremely tough times and are um in our many different communities in our County in our state and clearly in our in our nation but um but we are all committed here in mdusd to support our young people and to make sure that they have all that they need to be successful so we will continue to strive for excellence we're not there yet but we're going to continue to strive for that and um and I'm excited to be right along with everyone else in that Journey I just um you know I just can't get over this

picture these are students from this is actually our old boardroom if you recognize it we spend so much time over there but this is what it's all about and um you know and and um you know I am 100 committed to these young people and making sure that they have every opportunity that they need to to be successful and I'm now I'm going to transition into a very serious topic because it's it's what we're doing as a district to um to keep these students safe and to ensure that we have the systems procedures and protocols to um to do the best we can um I I went over the natural um you know the the natural challenges that we are facing in our you know in our in our environment now but not only do

we have the natural environment to you know to be weary of we also have um you know some human elements that we need to be to be cautious of so what Mount Diablo has done what we're bringing um forward tonight is we are bringing forward a a contract of a partnership with um individuals who this is what they do they are um you know they are disaster preparedness um trainers and Educators and um and so I am going to ask um John Ortega from rockeye Consulting to come up and present this item I also just on a just on a side note we we also have I know this was item this was item um eighteen two eighteen two I also just if I could ask if after this if we could just um quickly

do 18 3 we just have two members of The Measure J um who are just here to do a quick presentation and I really don't want to keep them any any longer but a very important topic and a very important um a very important um contract that I wanted to move up in the agenda because of its importance not that every single thing on this agenda is not important and not here to support young people but I think in our in our current times that I wanted to just give extra attention to this and so without any further Ado um I have um Mr Ortega who will be presenting this item and he has a presentation and we're going to be popping that up on the screen in two seconds I want you to go

ahead and introduce yourself sir and the floor is yours I was going to say good morning but good evening [Laughter] great conversations going on President Mason trustees Dr Clark superintendent Mr Alvarado cabinet uh members here of the audience my name is John Ortega I am the principal partner at rockeye Consulting uh basically what that basically means is I'm just the co-founder of the company uh is a simple way of saying it so this evening as Dr Clark was elaborating on uh you're hearing a lot of things in the news and a lot of districts and a lot of reviews that are occurring right now as we speak uh and I can touch on a few others that we are currently doing as well um in touch on we're just right over the hill in Berkeley

as well they're going in their full services and reviews and things like that also uh so if we can just start off real quick um see there we go just a little bit of cover who we are what we do a little bit about the proposal to kind of give you a little bit more of an overview perspective as to what it means uh and then also what is a video surveillance assessment what does it mean what does it look like you know and what are the outcomes for yourselves and then obviously any questions um and for your protocols I don't know if you ask questions during please or at the end however you want to do it please just stop me and I can elaborate a lot more so this is just a little

bit on my background and who I am just to kind of give you an overview I did serve in law enforcement up to the rank of chief of police I did attend the FBI National Academy I am certified as well as a few others and Department of Homeland Security that's why we're able to provide you and offer you these added levels of training and certifications uh that's going to be provided to your staff but not only to the staff at the school sites but also to Dr Clark and his cabinet and the rest of the directors and create an Emergency Operations Center and I'll touch a little bit more on that and how that's all going to work uh it's all down but again this is uh been very privileged to attend again Homeland Security

training is in Anniston Alabama uh that's the main Training Center there I did attend New Mexico bomb school out there as well at New Mexico Tech as part of Homeland Security as well as you can see what they call Seaburn it covers the whole gamut of what Seaburn actually means chemical biological radio logical nuclear and explosives so that's kind of just give you an overview of kind of my background and others my business partner has a lot of experience in the disaster area he's also a veteran of the Air Force and flu as well so we've got to kind of blend ourselves together and our whole team has a lot of this type of background also uh again what we do here is you know we look at safety vulnerability assessments what does that look

like currently under the proposal this isn't one that we'll be doing for you but it gives an overview perspective on seeking those vulnerabilities and providing options for consideration to mitigate those again looking at training and drills and we'll get a little bit more into that but you know again I reference how we're going to be training your school staff the upper Administration as well and then we want to lay the foundation and how that's going to be established and then we want to build from there as they say you don't build a house from the roof down you build the foundation up and that's what we want to establish and that's how we'll get into all that School site safety plans as well we do a lot of review on that Emergency Operations Center you

see these acronyms you know in education there's a ton of them in our world there's a ton of them too cert just means School emergency response teams uh insert the other C is community emergency response teams is preparing your community for disasters to help out is is what that is this is the proposal being put forward in front of you this evening to get a little bit more into detail is review your comprehensive school safety plan as most you already know that has to be reviewed and updated every year and approved by you by March of every year but we really want to dial into it and and really look at it in the effectiveness of it not just another 100 page document that sits on a shelf and does nothing I mean let's be

honest uh and then the other part is the true emergency operation plan so what we're going to do is actually sit down with each one of your sites and evaluate that with their site team members uh and give them a true evaluation and update on their emergency operation plan and the effectiveness and how it can be utilized on a day-to-day basis if needed again not something on the Shelf but something that's effective as you can see too your left on this screen over here as well is also we're going to be recreating your site emergency Maps uh really not able to see so much of it but below is the legend itself and then it's going to explain all the icons and so we're going to actually work with all your sites in developing these

site Maps as you can see the buildings are going to be numbered you're going to have evacuation routes in there you're going to have medical triage areas identified you're going to have areas of parent reunification you're going to have all of these things in there all your emergency shutoffs or I should let me back up your utility shutoffs gas electrical water things like that those will be identified on this map so if I'm a new employee I can literally first day look at the map and know what I have to do in that emergency so again we want to make it very simplistic and user friendly in that manner um with that said as I mentioned about the Emergency Operations Center training is developing the emergency app Operation Center or enhancing what you already have

and then providing that layer of training on rules and responsibilities for utilizing and operating a true EOC as they call it in that manner as I mentioned about reconstructing the maps I already explained that and we're actually going to be providing a few drills at your sites after as well so as you can see we're going to come in meet with your sites develop your emergency plans provide them some levels of training what we want to say is the incident command system 100 for schools what is it what's the rules and responsibilities we always say that it's already there but now you're just translating into emergency World Language it's it's no different and so we're going to be providing that for them and this is something Mr Alvarado uh as I say squeezed us on

to add a few uh more trainings on top of that as well um coupled with an active shooter training uh not a drill but a training so an overview of providing options what to do in these types of emergencies a lot of what we train on is yes it's where you work but you haven't also an outside life so we want to be able to lend that self to your outside life so you can be prepared everyone goes to a movie a restaurant a market whatever it is you're out there out and about living your everyday life so we're hoping that that translates into that as well so it adds a little bit more value to the individual that's receiving the training and then as I said about the drills the active shooter that kind

of stuff and then also as part of that is the video surveillance uh assessment and so what we're going to do is actually come on to your sites and look at it and saying okay what existing cameras do you have in locations and then add a little more to that and the value of do you need more in certain locations identifying those locations but not only locations but angles as to where they need to be placed not just placing a camera and then have it static and just look directly straight we want to make it maximize the effort of that camera does It capture a full 180 you know whatever it happens to be that's where we'll come back with you this is just an overview as you will but it's going to be a

more detailed report and much lengthier and it's going to cover the entire School site itself as you can see there's different zones that will create as part of that system and again we'll provide that in Greater detail for you so when you do look at it you'll know exactly what we're referring to when we say Zone one two three or four or whatever it happens to be in that respectful Manner and then as I said we'll come back and provide that to Dr Clark and then we can share with yourselves as well as to what those reports will look like and that's it I'd like to keep it short sweet I have a quick question when you talk about which we hope never happens but if there's a active shooter or something you know the

in Mount devil you're dealing with a lot of different police agencies like I know because I'm an unincorporated area they have a whole Command Center that they roll out but so what also part of the plan being either getting them all to work in concert together or just each school knowing what that number is they need to call if they need something like that I guess it wouldn't even be the school it would be the district office calling and saying here's what we need that's a great question and that's the other added value that we bring because of developing those relationships between the sheriffs and PDS our police departments with the school sites by law when we have to rewrite these emergency Plans by law now stipulates that you have to have police or law

enforcement and fire sign off on these plans so again that brings and builds that relationship we can give the best as far as you know where to go in an evacuation and things like that but when it's all said and done they're responding not us even though our backgrounds will lend itself to all of it but in reality they're going to be responding appropriately but yes we definitely bring them together so that when we actually do drills we want to incorporate them into it as well okay very good thank you you're welcome any other questions I have some but at the navasaurus and then you um I had a comment um okay sorry that's that's the microphone um but uh at Mount Diablo High School we're divided into academies and I'm in the medical and

bio biotechnology Academy and I'm taking a healthcare essential class and we've actually gone over our school safe safety plan and gone through the drills especially at the school uh the in an incident of a an intruder drill right and what to do and things like that and we've also um taking incident command trainings and uh yeah I just wanted to comment on this that this is something super valid and super needed um and valuable in our schools to be implemented and like you like you mentioned monitoring and improving on our safety plans with our schools to ensure the safety of our students and their success thank you thank you first email um so this is a little awkward um the I have been involved in our school safety plans since the mid-1990s when we were

first required to begin developing the plan so this is an area that is of interest to me the um and I do value your presentation and I am supportive of the process and the initiatives that you've laid out but I have a con a question for Dr Clark and our staff because and um August of uh 2019 the board approved and um wait a minute why why can't I see it a contract with pkb ready uh to assess Safety and Security of all district facilities and to develop an implementation plan for any needed improvements and that contract was uh 227 thousand dollars which is uh uh more than the current contract that we are looking at my questions were um what were the receivables of that because I have the generic information that was provided

on the docket uh did we receive those uh was the vendor paid and is any of this information usable under this new contract and can that information um not that I'm I'm sure that Mr Alvarez has spoken with you about the value of the contract is there perhaps a bit a greater discount if the information is usable so I am interested in more information about how the previous contract worked was it successful and how these two contracts differ I understand and can see that there will be a greater involvement regarding the video cameras with the zoning and everything and some other details great question so um so that that particular contract predated me but I have read the contract and I've actually gone over it extensively with Dr Gonzalez and she's actually refers to that

contract often that contract really focuses on our facilities and so fencing door locks um you know putting Columbine locks on every door you know hardening hardening our campuses that is you know to to give you an example that is really what it what it focused on was was our facilities and they examined every single facility and and whatnot and so we have that report what it did not include was an implementation plan and and the district never committed the funding to actually Implement those those recommendations so putting fences up at every single School putting um you know putting putting different locks changing our completely our locks on every single on every single door in the district that wasn't included I mean obviously the the price tag of implementing all that is beyond the what the

district could afford but that is not part of of this contract and and we we looked at both of those so we do have that facilities assessment of all of our facilities and we do have that and I'm sure the board must have been presented a copy of that back when it was completed and I assume that's kind of what led to some of the new fencing that's going on well that it does and again Dr Gonzalez and her team Miss koslow and whatnot they refer to that to that document all the time but what's just not there is the implementation and the funding to implement all the recommendations that were that were put on that were put on that plan so like for example um [Music] um the plants and trees and shrubs around

around each school is identified in that plan right so in this contract we're not talking about looking at the the physical plants he's talking about examining our Maps making sure that our maps are accessible to staff and you know fire and police if they come on campus looking at the angles of our cameras um you know the other the other plan looked at you know installing cameras throughout the district and putting all those on one system so I know Dr Gonzalez is back there am I am I doing this Justice or would you like to come okay I mean that's that's what we've been talking about this for you know since you know for the years that I've been here but this is this is kind of The Next Step the next step of that

and again there wasn't a there wasn't a financial implementation plan attached to that to that assessment that the that the board um you know approved severally several years back so did that answer your question uh yes and I'm must admit I don't recall receiving a copy of the report when it was finished but that doesn't mean that it wasn't provided and I just have um misplaced it um so perhaps Dr Gonzalez is going to come in this would be like you said this was uh arranged by a previous superintendent and a previous CBO correct um there are three individuals that have copies of the reports uh Miss kozlo myself and our attorney Cesar Alvarado because of the confidential nature of what is in there we never did send anything to the board because it wouldn't

be appropriate if there's any board member that would like to take a look at that report I have a physical copy hidden in my office you are welcome to come by and I can let you take a look at it but because of this secure nature of the information that's in there we have not made it available and we've kept it between the three of us and I do recall that about maybe later that spring so if this was in 2019 perhaps in 2020 spring when the uh uh plans came to the board there was a change in that the old Maps were no longer included in the the actual plans there was more information redacted from the reports beginning in 2020. uh so I do recognize that there was a change in uh the

actual what do I want to say outline of the plans uh that were presented to the board so I appreciate that okay thank you from board member first you want to go first to public on my first Katie Cisco thank you for your patience Katie so I didn't uh hi hi um so I didn't realize that the presentation would be done so my my comments are prior to that information um so I'm Katie Callahan Cisco my husband and I have two children at Ayers Elementary uh in May when the Uvaldi shooting occurred I was filled with anxiety that um follows these incidents in July when the minute by minute timeline came out um about Uvalde my anxiety turned to anger and a need for understanding and a need for action on July 18th I sent

an email to superintendent Clark Concord PD members of the Contra Costa Board of Supervisors the sheriff Contra Costa Office of Education Ms Mason and Ms mail um from the board my intention was to cast a wide net and see what the county-wide response would be and Ms Mason um and Ms Mayo um your thank you for your immediate responses that you sent me something a response that day um unfortunately when I heard from each of these different agencies um they all had separate plans nothing that overlapped and nothing showing any collaboration with each other um I've discussed active shooter protocols with other parents at our school we've all searched for information about the response but but but these events we could find nothing in my email I requested that if any public information was accessible

could someone please point me in that direction parents just want to know what the plan is because of the hesitation that happened in Uvalde the chaos that incurs when these incidents happen um you know I don't want to drive my car through the middle of campus in order to you know because then I can become part of the problem I understand that um so I appreciate that you're moving forward with the rockeye Consulting I've read The Proposal it contains valuable information about safety prevention surveillance and Emergency Operations but do these trainings include um thank you local law enforcement agencies The Proposal is filled with Federal level expertise but I want to know that the school district will collaborate with local law enforcement to address these man matters uh let's see um so my questions have

been about uh preparation but I also want to add now that communication to families um we as parents need to know what's happening we need to know on-site what's happening we need to know that if the person who's supposed to send out the text message is incapacitated how does that work it out all of these agencies need to be working together to share ideas what their challenges are what their strengths and I don't want parents anywhere to have to go through what those families went through and I'm requesting that um a town hall be set up for to combine these agencies to collectively um get information out to parents throughout the community well after the park when shooting I was president of the board at that time and I talked to Dr Meyer who was

a superintendent and we held such a meeting in this room we had a representative from all the agencies from the Sheriff's Department Martinez police where all of them came as well as some of our staff and it was around the same time that we were looking at getting this other contract that um trustee Mayo referred to and they loved it and we talked about having a code where it didn't matter what department you were with if you heard this code and you were near a school that meant active shooter get there as often happens and I take responsibility the superintendent left other things came up and we never met a second time as soon as this happened I knew what I was watching was not what's supposed to happen is not what law enforcement is

trained for I got in touch with Dr Clark we were on the same page and that's exactly why we're moving this direction I've already talked to local sheriff he's talked to Concord Police we're we're connecting those departments to talk and I said the parents need to know what to expect to see as well because as much as your gut tells you to run to that school that might not be the best thing to do to help so we need to know in each Community where do the parents run that there's going to be a command center that answers our questions so we're totally on the same page and that's why we want to look at this contract and get all of us there and not get comfortable a month from now and think all things

are fine I hope we get to a day where we wonder why we ever did this but we're not there yet president Mason I know it's not our practice to respond to public comments but I want to so I'll respond to the board and I want you to listen okay so um so I received I've received emails from a very concerned parent and whatnot and um and so interesting a lot enough just to kind of explain how we got here with the with this rock eye contract is short shortly like the week before the evaldi shootings this board approved our safety plans and every every one of our schools has a has a safety plan of what to do and it's it's the public plan we also have we also have plans that aren't public

because those were jeopardized you know what we have people's we have phone there's phone trees involved and things like that nature we don't want to we don't want to make public however after um after the school year ended because it was right around when the school year ended this summer The Pleasant Hill Police Department put on a a active shooter training for the Pleasant Hill Community myself trustee Mayo um chief chief academic Officer Jennifer Sachs we all attended and um and and got a great deal out of out of that active shooter training that took place we then reached out to the Pleasant Hill Police Department and the chief of the Concord Police the sheriffs were already working with our Bay Point schools but we have organized a um a staff training for all administrators

that's taking place next week with the Pleasant Hill and Concord Police Department following that training there will be a community Town Hall that as soon as we as soon as we confirm the date and it will be an in-person event we will have a community Town Hall from from those two police departments the the good thing about being in California and being in the Bay Area is that regardless of the police department they all go through the same training and protocols when it comes to active shootings so as we get that information and as we update all of our safety plans and our layout our training protocols for the year for our staff and and communities we will have everything everything will be put together and all of the questions that were included in the

in the parents email to all of those Community folks will have been will have been realized we have we would have as a district we would have tightened our processes and procedures we would have gotten training um from from all of our administrators with the active shooter trainings of our local police departments we will then have all of our safety plans updated and and and our Maps updated and basically modernized to deal with this issue and then we'll have a parent uh Community Forum where parents can come and hear the same message that our administrators are hearing from our police departments so that's why we're here tonight and that's why we have that's why we have have Rock eye bringing this proposal forward because again although you know I know a lot about safety training

I don't have the expertise that that Mr Ortega and his team have go ahead go ahead come on yeah yeah yeah we'll we'll work on that we'll work on that thank you I know yeah it's not going to be here it's going to be in the gym so just so you know many people want to come all right okay thank you uh thank you I mean all of this is really great information really great input and ideas um and uh I was just thinking about this as a parent who's been on a site Council that needed to approve the site um safety plan and the way that it's set you know it's it it includes all the things that it's supposed to include but I like what you're saying about what this does is modernize

it because the setup of the format of the report by that we are required to do by the state is like you know it's just pages and pages long it's not very easy to read it's not very easy to refer to quickly in an emergency situation and those sorts of things um and so um I appreciate that this process will kind of modernize that allow everyone to get on the same page from the police departments and and local agencies as well as for parents um to understand what the plan is and what each person's role is for each different scenario because we have so many different potential emergencies um you know that we're all thinking about for our school sites right now I'm just looking at the way that you have those maps and the

different zones and you know what the purpose of each of those zones are for I think is going to be very helpful go ahead so okay oh yeah um but um so I just want to appreciate that um I also appreciate that you said that the uh active shooter was a training and not a drill because we have heard from parents who are concerned about the idea of holding an active shooter drill where you know like elementary school kids would be needing to act this out so what I'm hearing you say is that is not a piece of this okay so I appreciate that um yeah so thank you not I think this is an action item is enough okay alrighty entertain a motion Madam president I move to approve the contract with rockeye Consulting

to establish safety plans perform safety assessments and conduct safety and emergency training second you have a motion in a second Christine Avi Flores yes and that passes five plus one thank you I think we'll be seeing more of you okay and Dr Clark you wanted to move 18 three was it up to yes I'm looking for I'm looking for Dr Gonzalez so Dr Gonzalez we we want to come introduce your your team thank you very much I would like to introduce the chair and the vice chair of the measure J cboc citizens Bond oversight committee um it's been a pleasure to work with these uh two leaders this year Well at least over the last few months since I took this uh this group over um every year they are scheduled to come to the

board and do a presentation and give you all an update and so that's what they're doing here this evening thank you so good evening Dr Clark members of the board staff and members of the public I'm Gina Haynes I'm the chairperson of the measure J citizens Bond oversight committee so tonight we're here to present the annual report for July 1st 2020 to June 30 2021. I'm going to work this thing yeah yes um so on May 13 2019 the board appointed a majority of the members of the citizens Bond oversight committee for measure J um I currently sit as the chair and Michael Langley as Vice chair so during this period the committee had four meetings where Quorum was present at each meeting while progress on projects was slow during this period the committee did

review quarterly expenditure reports the independent audit was informed of progress on technology and its security assessments and saw notable progress on the district-wide facilities master plan and the needs assessment this slide just goes over the action taken at each meeting so under the direction of Dr Gonzalez the committee has seen vast improvements on keeping the measure J website current with reports presentations approved meeting minutes um we've seen timely noticing of public meetings and providing backup documents to members and then the development of the project priority list based on real data identified in the updated facility Master's plan master plan and needs assessment so for the annual report for July 1st 2020 through June 30 2021 the 2018 measure J citizens Bond oversight committee has not uncovered any deviation from prop 39 requirements so in addition

to the submission of our annual report tonight the committee would like the board to address the unexcused absences and consider removal of two members according to the committee bylaw section 5.6 removal vacancies the board May remove any committee members for any reason including failure to attend two consecutive committee meetings without reasonable excuses upon a member's removal the seat shall be declared vacant so there are two individuals that have missed the last two meetings these members have had a history of poor attendance missing between eight and ten of the 14 meetings that we've had over the last three years they um did not know notify the chairperson or mdusd staff that they would be absent they regularly received communication from Dr Gonzalez who clearly explained the need for a quorum and each was individually contacted by

the Vice chair in early August prior to the meeting and still did not notify staff nor attend the last meeting so tonight the action that we're asking you to take is make bacon two positions on the cboc due to lack of inheritance to measure J bylaw section 5.6 this concludes my report thank you any questions no questions I appreciate the report I just wanted to point out to the board that we will be taking action on this particular particular item which is the presentation or receipt of the report but 18.2 which was 18.4 will be the later consideration uh regarding your second request I think the agenda item Dr Gonzalez says no no then what is the second what is 18.2 then so 18.2 um that's the item where I'm asking you to make the

vacancies into specific areas where where we're redesignating the seats so this is an action item you're receiving the report and we're asking you to act on the recommendation to create two vacancies okay we're not specifying which seats the vacancies are because we're doing that in the next item so this one had two items it's not one combined correct okay well yes this is this is two items put together we probably could have listed it as two but then we would have had three in a row we thought that would be more confusing okay okay thank you so we are you have to do this emotion to review and acknowledge receipt of the annual report in the 2018 measure J citizen Bond oversight committee for 2021-22 and approved vacancies of two seats right and that's at

all this one so that's what we're right now can I just say so moved since you said it out loud thank you so moved thank you second okay we have a motion in a second trustee Nava Flores yes and that passes five one very good thank you for your time volunteering all righty is that all we're moving up right now or Dr Clark yeah we're gonna get we're going to do the next item later on okay but you guys don't have to stay for that if you don't want okay thanks all right so now we're on consent agenda correct all right yeah he's doing it Laura not me okay so I want to pull 15.8 is there any other items that we would like to pull if not I would entertain emotion Madam president I

moved the board approved the consent agenda with the exception of 15.8 which will be uh pull which is pulled for separate consideration here we have a motion in a second there's no comments trustee Nava Flores yes and that passes five plus one very good okay the item I pulled no shot I'm sure to my fellow board members is we have an event coming up next week which in itself is problematic but that's okay um the way this has been explained to me it's one of my favorite things a contract where we're saying the people don't need to be fingerprinted so the way it was explained to me the last time is this agency plans the event but don't necessarily put the event on they just get paid to plan the event their event planner so

who hires the DJ then we're hiring the DJ or the DJ come as part of the package deal so the event planner the events to the team the gentleman who we work with he has a list of vendors that we utilize as a district so my understanding is that sometimes some of those specific people so for example the DJ is probably what you're concerned about um I didn't I do not know if he is actually fingerprinted himself now that being said the gentleman who runs events to the t is fingerprinted at this particular event we have a bunch of different games and things coming but not people with those games so maybe the kids will be doing like uh I don't even know what they are like Skee-Ball or video games arcade games photo booths

those don't have people with them we will have 25 volunteers at the event who are all fingerprinted who are either members of our staff or parent volunteers right um the DJ himself I cannot say that he is fingerprinted I do not know but the DJ will sit separate at the children and there is an admin who's the go-between for you know the kids come up and say okay I want a certain songs of it so and then the setup is that all done by parents and volunteers so my understanding is yes that the parents and the volunteers are setting up now even so the team brings all the stuff so I can't assure you right now in this moment that there aren't people who drive the truck right um okay my only concern is maybe

high schoolers have changed but when I went to high school dances I always could find a way to sneak out and do stuff I probably shouldn't be doing outside so I just want to make sure if we don't know if this DJ is fingerprinted or not that there's always someone with eyes on because I guarantee there also will be interaction with kids when you have a DJ yeah yes so when I spoke with the principal at Northgate this morning what she said is they have an admin so the DJ is set like on a stage or separate from the students and there's an admin who sits between the DJ and the students as they come up and request songs okay thank you very much are we approving tonight for um the Improvement of the independent

service agreement like the contract to hiring the independent team okay yep and like I said it's unfortunately it's next week so I don't want to ruin their homecoming and say they can't have this event but this is something you will learn maybe because I used to be a safety or person at my other job that I want to make sure everybody around our kids is checked out so I just keep calling it to their attention alrighty so having said that I will entertain a motion Madam president I moved the board uh approved the independent service agreement with events to the T and Mount Diablo High School District on behalf of Northgate High School as presented thank you I'll entertain a second is it second okay we have a second and uh let's see Nava Flores

yes and I'm going to assume the assurances I got were correct so that'll be five one already that takes us to our business now which is 18 oh I got a card 18.1 review and potential approval of certification of District 20 21 22 unaudited actuals financial report and um let's have the report first and then we'll have the public comment uh Dr Gonzalez and team or just Dr Gonzalez seems like it's one of those nights where everybody's running back and forth to their offices uh so good evening tonight we're presenting the unaudered it actuals I do want to let you know that this afternoon based on some of the questions that we received from you we've added in a couple of additional graphs in order to better explain so really what the unaudited actuals are

huh um it explains what we received and what we ended up doing with it because as you know a budget is our best assumption based on a number of assumptions of what we're going to do in a given year so a budget is really a plan so the unaudited actuals from the background about this is It's required that we do this it's one of many phases of budget development and the reports that we do every single year every single School District in the state of California does this if anybody wants to look at past years everything is on our website um but it it gives a specific picture of one day in time just like our interim reports do in this case it's as of June 30th and so it really takes us about three

months to close the books and get everything ready and so what it does is it takes into account all expenditures and all revenues as of that day oh I do want to point out that this is verified by our external auditor our external auditor is uh Crow and Associates I think it's just Khloe used to be Crow Incorporated um and that report is generally presented in either December or January hi so we'd like to look at the revenue how it ended so School District received revenue from federal state local source and uh that is divided in I'm restricted side and restricted side so the table shows that one in different categories so we want to look at the first category unrestricted general purpose Revenue this is the revenue the biggest Revenue that school district received

based on APA and this has a three component property tax EPA education protection plan and also um the state aid to make up the difference and this year we received about four million more which happens sometimes they they estimate the property tax how much we're going to receive and then they're gonna give us the rest EPA and state aid and what ended up happening was we received more property tax than they anticipated so we're we received about 4 million more so we are anticipating a prior year adjustment in and federal revenue and restricted side we stopped receiving we used to receive like um cost money and other things we don't receive it anymore um other state revenue in unrestricted side this is the lottery and the mandated block grant close product um and other local

revenue on unrestricted side this is uh use permit revenue from the local businesses local you know groups and also the interest earnings and uh let's go to the restricted side yes it's still here no not yet um so restricted Revenue federal funds this is like the title programs title one two three four one is um uh based on the free and reduced meal count uh two is like more like professional development and title three is English learner um those different things um and also CSI funds many different funds but CS icons is uh I have to remember this comprehensive support and Improvement funds um among different federal funds and this 36 million includes about the 18 million of covet one-time funds um and then a state uh restricted funds 19.6 million out of 7 75

million is again the uh some kind of one-time funds some are covered related and some are like a through G Grant and at this point we received just one time um and educator Effectiveness is part of it and starts on behalf is part of this 75.8 medium and uh local Revenue restricted side this is from the local um organization uh parents parent Club City uh and a different kind of agreement and then next slide is uh it's showing the contribution to the restricted side this is a contribution from unrestricted general fund to restricted general fund and um we contribute to jotc special and routine research and maintenance this is the three percent and also um Athletics and uh small local programs um if you notice um 21 22 compared to 2021 it's a significant increase

this is due to mainly uh well 2021 we did the distant learning and we had much less expenditure in like especially special ed transportation and also the uh site level um extra time that was spent or extra money it was spend and so if you look at 1920 which was partially uh we closed but mainly we still open so compared to 1920 2122 is about the same level so um we think the contribution level just went back to the historical level so the fund summaries so fun summary is a combination of Revenue and expenditure and the revenue uh like we talked about um we received 4 million more and also uh the local um restricted I didn't touch on that but uh user permit we received more about one million more than we anticipated an

expansion side um just like last year we moved as much expenditure that we can pay from Valentine funds from unrestricted to restricted we did it throughout the year but at the same time we did more at the end of the year um one of the example is like you know some teachers cost rate uh we increased uh compared to the beginning of the school year the difference we moved it to one-time funds and the historical you know regular rate would be paid from and we started the fund um and the other change was so textbook adoption cost we budgeted for it and we ordered it but we didn't receive it so we it was not recorded in 2122 book so we are anticipating that to be recorded in 2223 um another thing is um um

some settlement we anticipated to happen within this year um it seems to happen next year I didn't see the expenditure actually happened and also uh when we were closing there were some expenditures expected to be paid out of title one was moved to different restricted program and September 30th is the deadline but we can kind of guesstimate how much it will be and with Title 1 funds we have uh 15 um carryover cap and to clear that that requirement we moved some expenditure from lcf supplementer which is unrestricted expenditure to Title One expenditure so that kind of freed up the money and so and also special ed contribution came less than we anticipated it was the same level than compared to 1920 but it was a little less than we anticipated so all the combination

of Revenue receiving more and it is contribution or um less expenditure moving to unrestricted to restricted that resulted in notable increase in any converter so what part of what Mika isn't saying um in in what she shared is that you know part of our role in the fiscal side of the house is really to meet with all of our departments um to be really tight as as we possibly can with budget development and then what ends up happening is at the end of the year we wait and we see what happens and certainly at first interim we're able to do corrections second interim we're ready to do corrections and then what happens is the end of the year comes around and we have a lot of one-time funds that are either use them or lose

them title one is a good example but we have a number of those and so what we end up doing over the summer after everybody else is gone and they've closed their books we we sit down and we try to figure out okay what can we legitimately spend and move over so that we don't have to give back funds it's been exceptionally challenging over the last year because of new one-time funds that have popped up like we ended up getting 1.4 million dollars from the state that could only be used for covid testing and discussions about covet testing right and so then we go back and we try to find allowable expenses and when we figure out how to fit them in so this is what we have been dealing with over the course of

the last year what we tried to show here is we tried to show um since 2014-15 a history of exactly what ending funding ending fund balances look like we did it on the unrestricted side because that's really where we have the most flexibility we don't necessarily have that with restricted because you get this dollar and it could only be spent on number two pencils that are a specific color right um and so we've got the combined ending fund balances that you see over on the side um you know one of the questions that we received was why is it that we're at 87 this year like what happened in 2015 2016 the same exact thing happened back then we went back and we did the research and found out that there were some one-time funds

and what was the other thing that happened in 2015-16 um 16 17 New Hampshire race okay so that's that's where um one of those big drops happen you see with the 13 million from the um 1516 unrestricted from the 83 down to the 70 and then that also played out in 1718. so you can see how some of these things um are trending over time when you start moving Title One funds so they don't go back that's all well and good but there's restrictions on Title One funds about if it's title if you buy it with Title One funds it can only be used by Title One students and direct that gets really dicey correct and so what we have a tendency to do is we have a tendency to go back and look at

some of the personnel and try to see if there are any other things that we did over a given year that let's say we were going to spend out of lcff supplemental are you guys hearing that same feedback that we are okay just wanted to let you know um but we go back and we try to be very specific and see what those restrictions are and if for example we were planning on something from lcff supplemental or in some of these instances we were planning on spending some funds out of s or two or s or three or even assembly Bill 86 we go back and we move it because we know that at this point in time Title One is the most restrictive and so again we wait for everybody to do the spending

and then we sit on the back end and we figure out what it is that we can move around to try to keep as much in unrestricted that we possibly can yeah I just want to add when we move the title um any expenditure to Title 1 funds we work very closely with that service especially Jennifer stats to make sure that we are not doing anything out of compliance there are a lot of phone calls and emails that go back and forth yes yes right um in this transfer from unrestricted to title one is this something that all districts do in California is it always typical this time of year predominantly and is it considered a sound business practice by CDE and other agencies yes I'm glad you asked that question one of the things

that the fikmat report pointed out is that we're actually doing a good job so back with that initial checklist that they came up with a year ago they said yes we are absolutely moving those funds the way that we should because there even whether it's thick mat whether it's School Services whether that's County Office they're always reminding us you spend your most restrictive funds first you never want to give anything back and so we try to work really hard to do that school districts across the state do that every single time they're doing their unaudited actuals and they're closing the books because none of us want to give money back right and but we don't know on the fiscal side we can have everybody do their best estimates and we're having them in cumber funds

and we're reminding them to spend them but at the end of the day if for some reason like textbooks is a really great example um not that it's tied to title one but we put those orders in knowing that they would come in in time the orders actually came in what didn't come in was the invoice that went with it and it took so long to get that invoice from the company that it made it impossible to try to spend that in 2122 and so that's some of the that's some of the dancing that that we see going on in the summer is um you know and that's why some of our busiest time of the entire year for school districts is really in the middle of summer because we're trying to do those reconciliations

across the board everybody's doing it foreign thank you for sure I have a question so do we have a record then of how much money we've had to give back over the years like or have we had to give money back in terms of Title One or things like that it barely happens um title one I have never seen it uh last year we couldn't meet the 15 requirements so we asked for waiver but that waiver is not like something we can ask every year and um the the money sometimes we send back uh is like Academy money we receive money for uh from the state for the academy and um sometimes we don't have the enough eligible student and at the end after we close all the book and then they look at eligible

student and we didn't meet the the minimum number and so that ended up okay we are gonna receive this money and we have to give back there was a report that we recently received from the County Office of Education and and what they did was they took all the school districts in our entire County and they showed us exactly what was left in in Title One spending and at that point in time I think we were somewhere in the neighborhood of twenty seven hundred dollars that we hadn't spent that they wanted us to just go back and double check there are many of our neighboring districts that were well into the three figures of items that they were going to need to shuffle around and as a matter of fact within the last couple of

days we received another reminder and it showed all of the districts and there are still districts that are trying to move like one District had like 290 000 that was trying to move um into title one because some of the things that they had expected to do during the year didn't happen so um we do a really good job Mika and her team do they do a very very good job of being able to stay on this and I want to um I want to commend uh Don Edwards because when she was working with Mika on a regular basis they were absolutely on top of that and so we do have a history of if we're giving anything back it's a small amount but typically we don't thank you we have a public comment Kip

penovich what oh don't I'm sorry oh no no I've I've I've got a few more um so this light here um this explains a little bit more about our um our unrestricted revenue and again Mika talked about the textbooks and the textbook adoption that was about 10 million dollars that we had planned to spend the transfer to covid funds um we ended up really taking a look at a lot of our substitute expenses and moving those over this past year um a lot of typical expenses that we would see for substitutes for example um the governor just extended the 10 eligible days for covid through the end of this calendar year and so a lot of those absences that normally we would we would see you know people would be calling in sick we've actually

taken 100 of those and we've moved over to covet funds so that's why we end up seeing more in the um unrestricted expenditures that end up as we say falling out at the end of the year foreign tells a little bit about that same exact thing books and supplies in Services we did go in and we took a look at all of these I know that there were some questions about the School site local budgets there's a great deal of local budgets that are tied to programs at school sites and often um what you'll see and I know that I shared some examples there are some schools that have very large grants and they're multi-year grants and so it takes them a while but everything it falls into this area at the end of the

year and it looks like books and supplies weren't spent it's because they're grants that are held up services came in approximately eight million dollars lower than we had expected a lot of that came in with um with special education we did have some maintenance and operations projects that were a bit delayed and so we know that we're going to hit those this year what's also not listed here is we had some Vehicles so you'll remember about a year and a half we brought you a whole host of vehicles some of those vehicles um we were still waiting for the little widgets that go in and make them run so um vehicles have been delayed around the state and then we're continuing to get apportionments of some of these one-time dollars and so oftentimes we'll get

the apportionment at the very end of the year we'll get it you know right at the end of June and we're not able to spend that immediately or do the reporting for it um here are some things to consider as uh um as we move forward the good news is that it's not a whole lot of Doom and Gloom as we've expected um and you've been accustomed to me sharing over the last few years however there is some uncertainty around our enrollment and our average daily attendance I can let you know right now that we were very optimistic we didn't want to move too many indicators and assumptions this year moving into budget development so last year we were at a little more than 91 average daily attendance it means the number of days that

students come to school in a given year what we're actually seeing is the number is staying low uh for a number of reasons but the numbers are staying much lower than we expected we expected this year we'd be closer to 93.5 and then next year we'd jump back up to 94 where we were before um we're taking a look internally at attendance and what's happening with students and why they're not coming to school we've got a number of programs in place but that does affect us so when we bring first dinner and we're going to have to adjust that same thing with enrollment we know that October ski beds is coming up really quickly as as many of you are aware health benefits have been increasing so that's something that we're taking a look at

by all means insurance has gone up and although we're a district that has typically been trending very low in a lot of um like workers compensation and a lot of those the base costs that that have been happening um have certainly been going up and then stirs and pers they're going up and again we don't know what's going to happen with Investments I know that about a month ago I sent you all um an article that talked about the fact that the Investments were lower typically when the Investments are lower because the stock market is dropping what we end up seeing is stirs and pers rates and contributions on the district side increase so that's wait to see inflation recession supply chain issues um latest indicators are coming out is that everything is continuing to

go up again um new restricted one-time funds we are getting a lot of one-time dollars we're going to get them they're good for four five six years and you can buy a number two pencil and a specific color right and so it makes it really difficult sometimes to spend some of these so we've got to be very creative with what it is that we're putting into some of our plans um and then one-time funds you know as we continue to use up some of the one-time funds in let's say Esser or ab86 we were very transparent with the board and the community here are the new positions that we're creating as as the money goes away the positions will go away and what we're actually finding is in some of those cases it's very difficult

to take those positions away because a lot of what school and support services look like prior to covid have really changed I think technology will be one that you hear about shortly so these are all things that we're consider continuing to um you know we're we're monitoring it none of these things are super alarming these are just the types of numbers and the changes that keep us up and these are the types of articles that we read up on just a quick reminder the budget calendar you know we started in June with the adopted budget September is an opportunity to look back and then we continue to move forward so in December we have our first interim it's a check one day snapshot in time of exactly what our budget and our expenditures look like

we do the second thing in March we start looking at public hearings and the budget and the lcap in early June and then the last meeting in June is when we bring you a budget to be adopted so I'm happy to entertain any board questions at this point before we go to um Community comment if that's okay okay let me press so just to recap some of the one of the reasons that we weren't able to spend all the funds is because of the late timing of the arrival of those funds during the year some of them like educator Effectiveness was a big one we got the money what middle of June beginning of June middle of June and it makes it impossible to try to spend but it's something that ends up on our

books um textbooks would be a good example of that Vehicles would be a good example of that so yes and so the some of them for the School site carryover is it that they were unable to spend the funds is it because during the course of this particular year um they didn't move forward on the decisions to spend those funds or is it a you know it's a combination of many things because we're still coming out of the pandemic um you know as board members we hear frequently they don't have enough uh pencils and supplies and tissue for the classroom um that that's part of their site budgets I presume and um how do we assure that the sites are spending the money on the students that have earned it it's kind of where I'm

going you know that's that's something that we work on um the entire year uh as Dr Clark can attest almost every single tk12 meeting we're talking about spending your funds as a matter of fact I've already drafted tomorrow's presentation there's a slide that's reminding them you spend this year's funds on this year's students um there are two specific uh budgets that they receive allocations for we've let them know if you don't spend it we will sweep it and what we're I'm really excited to see what those numbers are because we sort of threatened it the year before and then we said well it was covid we're going to let you carry it over um I'll be curious to see how many of those funds didn't get spent but in other other budgets for example other

line items that they have in their in their budgets you know some of it has been Title One some of it has been a challenge to hire some of the staff that they had planned so that's certainly understandable um but there are many of them that are there um Community donation accounts their grants they are um they're a whole host of Department budgets and those types of things will carry over year after year after year so from our perspective we don't see that as our money we see that as School site money and having been a principal um we never want to go in and sweep those but what we do start to remind them of is look we can look back at five years of your carryover and I've got that back to 1617

and now we start really having the conversation since it feels like we're a little past covid to say okay every year you're carrying over 25 000 in this budget which means you haven't been spending it so what projects are you going to start spending it on for needs that you have at your school site we will caution them that a lot of what they have that becomes carryover they're one-time dollars right their Community donations are one-time dollars and so you don't want to you don't want to lock that up on people because you hire and then you have to release and that's never a good thing to do you never use one-time funds on on things that eat and breathe but we will continue to have those conversations in executive cabinet and remind School sites

of the way that that they can spend those funds I just had a question about the your Ada you talked about the need to adjust that um it's always frustrating to me that that we are funded based on attendance especially when we are asking people who are sick to stay home and sick doesn't count as attendance so um you know is there any uh word from the state level as to whether we could actually at some point become funded on enrollment like the vast majority of States fund education I think I think the data that I heard was that California is one of six states that funds every day based on the bodies that come in and sit down in seats rather than those that you have on your roster um I I hear about

it regularly um I I've not heard of any legislation that's been proposed I'm not sure if any of you have I'd like to be shaking my head yes to say that but you know what what that means is that the state would have to come up with a whole lot more money billions and billions of dollars every single year um added to the budget in order to cover that so it would be a shift in the way the state is is doing its prioritization and unless there's new Revenue coming in it would have to come from somewhere so we continue to hear oh we'd love to do this but I've not seen any actual uh action yet I think that you and I will be on on the on the on the front of the

line saying we need to have this but there's nothing moving forward that we can even advocate for at this point yeah all right now we'll take our public comment thank you kept Europe all right good evening um I'm here to talk about the unaudited actuals uh I kind of think the the discussion here can be the forest and the tree discussion uh because if you dig into the weeds you can miss the forest so I'm starting with the forest this District spent more than it ever has except for one year when it was just two million more um and yet it still had 40 million dollars left over so between the two last two years 80 million dollars have gone into the balance um as someone who was on the bar kind of the bargaining

side listening to we can't afford to arrays we can't afford and I went back and looked through the I'm going to call it propaganda that got put out there was always we can't pay you we can't pay you we got a raise um the books and Supply category it's the most it's ever been spent and that's fine the services and operating highest it's ever been capital outlay about the highest it's ever been and still with all of that there was still 40 million dollars left over and the only thing I heard during the whole year was we don't have money uh one of the one of the comments that I appreciated in tonight's presentation is kind of an acknowledgment I guess this is the only time you really know what's going on so when you

ask me well according to our interim I'm going to stop you and say that's not accurate because that well said tonight this is the only document that is accurate everything else is what people think is going to happen and if you keep track of the numbers historically they haven't been that great um about the only budget that sometimes is in the ballpark is the proposed budget and I think the only reason that happens is because it's based off the unaudited actuals and as soon as you get to the first interim and the second interim people just do what they think and so it was pointed out that there are certain categories that get over budgeted year after year after year so when people say we don't have money outside of the unaudited actuals I can't

trust that at all because that's just people putting numbers in places and if there's no justification for why did you put so much in there which it then it kind of comes back at the end of the year magically I don't understand why why people don't ask that question because it happens every single year so uh I'm glad we're in a good Financial place that's great but don't ask me to feel like you've really been upfront with me about this because all this extra money just all of a sudden appeared between the second interim and the unaunted actuals and it happens every single year foreign and there should be some knowledge about why that happens thank you thank you and if that was an action item correct okay I'll entertain a motion unless there's other

any other questions I move that we approve um The District's 2021-22 are not at actuals financial report thank you second motion and a second trusting Ave Flores yes and that passes five one eighteen point two we already did so the new 18.2 is oh second part of this got it oh I don't think we need any more information we just need a motion Madam president I'll move that the board approves staff recommendation for change in membership on the measure J citizens Bond oversight committee thank you second the motion in a second trustee Navi Flores yes that passes five plus one okay now we have our review and potential approval of membership renewal for the community advisory committee Madam president I moved that the board approved the renewal recommendations for the community advisory committee Dorothy weisenberger

Janine Payne Natalie ivankovich Lisa buffum Theresa Bowman Marina jerimaldi Ken Madeira Janet Mueller and Matthew Zamora thank you second you have a motion in a second to believe if there's any discussion and a thank you to everyone for all of their time and efforts on this important committee thank you very much so okay trustee Navi Flores yes and that passes by one very good View and potential approval of the Mount Diablo Unified School District's Sunshine proposal for 2022-2025 successor contract to the California School Employees Association and CSEA Sunshine proposal for the 2022 through 2025 successor contract and we have uh Mr Sheehy is going to take this item yes so tonight before you you have both the sunshine letters from mdusd and also from CSEA we are looking forward to sitting down at the table

with CSEA in the upcoming weeks and reaching a fair contract for for everyone questions Madam president I moved to approve the mdusd sunshine proposal for the 2022-2025 successor contract to CSEA and csea's sunshine proposal for the 2022-2025 successor contract to mdusd thank you second you have a motion in a second trustee Navi floors yes and that passes five plus one and that takes us to 18.7 review and potential approval of Staffing increases renaming of the technology and Information Services Department to the Department of Information Technology and related new and revised job descriptions Dr Clark thank you Dr Clark uh I'm presenting for your consideration a plan to ensure that our technology department can more effectively meet the needs of our students and staff uh including um an increasing demand for Technology support this is an

example uh in the in the 2021 to 22 school year we had 16 200 Open tickets in the first five weeks of this year and Mario and Mike can attest to this uh and the tiredness in their eyes can attest to this we've had 5277 Open tickets just in the first five weeks of school or through five weeks of school so um we can see that our one-to-one Chromebook program um the increase in classroom use of Technologies uh the deployment and management of devices and digital tools and also securing our Network against cyber threats is is definitely increasing as a requirement of doing business this way um so this proposal includes uh just to be very brief an increase of two network technician one positions and those are actually positions that Mario and Mike Phil

um uh or similar positions to those and an additional two positions that would be would be moved to ongoing funding from short-term funding um this is there's also an addition of a data integration administrator and a network manager and the moving the conversion of a database administrator positioned to ongoing funding as well um this proposal also uh incr includes excuse me I'm tripping over my words tonight this proposal also includes a change to the department name to the Department of Information Technology um to better reflect the broad range of services that we now provide uh and finally I just wanted to mention um that we're also uh presenting this plan and recognition uh the parallel process uh that is in collaboration with Teamsters that's ongoing right at the moment um to update our 20 plus

year old job descriptions for our Network tip ones twos and threes um technology doesn't change in 20 years so I don't know why that's important but but that's also uh included here so I'd be happy to answer any questions you have I know when you came and shared your technology plan in the multi-use room before and I said well this sounds really good but you're not talking about the money part of it well the chickens have come home to roost haven't they um I'm a little anxious about it being an action item for the first time we're hearing it I guess I don't know enough about what you do to compare it to whatever like jobs are so I would kind of like to see a range for these type of jobs what is the

salary and also I'd like to see you know when you get three years out I mean according to the last speaker with no worries because we always have more money than we know what to do with but it's a big price tag and I'm not saying you guys aren't worth every penny of it and I know that the job had changed whether we were ready for it or not for the covet so I I just from where I sit I need a little more information but I'd be happy to hear questions from the rest of our board members this time but thank you for your presentation all right um uh as a as a techie engineer I'm really excited that you're going to be called the I.T Department oh my gosh it's about time um

and just all of the updating that's being done um so the the motion that is on the tape or the the action that is on our agenda tonight I just want to clarify that there that these items have been um in agreement with the teamsters is that correct uh that is correct we've shared this information with teamsters and and that's correct thank you any other questions just so so the board's aware uh Mississippi has also gone through a fairly elaborate process with HR so in developing the job descriptions reviewing them considering which duties may be designated as um for getting terminology in terms of uh essential duties or not so we feel pretty confident that um uh what he has set up is is not only necessary but he has done some due diligence just

so you know okay so I understand you're concerns about the expense especially in the future years I did ask a question of why there was a bump and the response was because we're moving uh from a one-time fund use back to the general fund um the expenses or the requirements for repair and attention to all of our electronic devices is not going to go away in fact it's probably going to increase unless we have some sort of magical tool that's suddenly available for all of our students that doesn't require if it doesn't have devices or you know chips in it so I guess um I'm feeling more confident about the proposal that we have before us today I move that we approve the Staffing increases in renaming of technology and Information Services Department to the

Department of information and technology and related and new new and revised job descriptions second Christina floors yes and I abstained rather than said no just because I personally don't feel like I have enough information but I'm no way I'm against your your um Department moving forward so thank you all we're excited thank you I just want to see how a 20 year old um job description how that relates to the one-to-one model right now so not very well it goes from a mechanic I think it goes from a slide rule to yeah okay so unless I've missed something that was the last on our agenda for this evening so other than the board members having to sign a bunch of resolutions we are
