to vote and passes five zero zero zero so um just a minute make it more exciting for the staff we're going to make another change um so we had a mix-up I think up on the diet sometimes if I missed a card or something of a public comment um that we should have included so we're going to offer that opportunity now so thank you so much and uh thank you for listening to the concerns of our parents and students and my colleagues I wanted to just kind of pig you back on some of the things that I heard in the other area about the split classes the um the need for more full-time teachers and for substitutes it is so difficult for us to get substitutes it's unbelievable I teach first grade at Bellaire Elementary

School on Friday I had eight fifth graders in my class the class had to be split few classes had to be split up because we didn't have substitutes and we also are missing a full-time teacher um so eight fifth graders on Friday I had five today um it's tiring and and I know that those fifth graders are not getting the education that they deserve also Bel Air Elementary has been broken into four times in the last two years and four complete class sets of Chromebooks or iPads have been stolen all of our testing for the district is done online and classes are forced to share iPads within a window to get all the testing done for lower grades our computer labs are not equipped to handle logging in first and second grade students it will

take teachers 45 minutes to log in all those students into the programs that they're supposed to be testing on we've been told that the the iPads of Chromebooks will not be replaced so I think that's a major concern for Equity also and we're really pleading that you guys consider bringing more school counselors I just heard about these these expulsions and I'm thinking how can this be prevented if we can reach these kids from you know for from first grade since I've been teaching in this District I've had students who have gone through every possible type of abuse you can imagine who have witnessed unspeakable acts of violence who've witnessed family members murder some by other family members and our school has one counselor it's not enough and if we can get these guys the services

they need hopefully we won't have to be expelling them from our district my husband I am Mario to Tiger Lord um I just wanted to urge you guys to get a contract for these teachers I watch my wife and this is just one teacher it's been an extra 12 to 14 hours a week on curriculum my school things that they don't get paid for at all anyways and when they say fair contract I mean I've been in construction my whole life I would not nobody would show up to work and these teachers are showing up to work over and over and over and over and from what it looks like to me on the outside is that you don't take them walking out seriously you know I know for a fact my wife can get

a job pays way more money than what she'd make being a teacher and so saying that I know for a fact that there are 200 other teachers to do the same thing because they're in Jeopardy of not only losing the teachers that you have but losing the positions that you have and maybe it's a volunteer thing but it's gonna if nothing changes it could all stayed the same it's just going to explode on Mario thank you thank you very much thank you okay so now we're going to go on to a public employee appointments uh spring thank you so much we actually have three uh hopefully new employees this evening the first one I'm going to go through is she happens not to be able to have been available tonight her name is Catherine kinsella

uh Catherine is joining us we hope as a program specialist in special education she has over 20 years of experience in the field of Education served as a paraprofessional preschool little teacher a lead psychologist at the end for the fairfield's assumed Unified School District and then went on to work as an assistant director of special education at a private Management Group but yet she's bringing her talents here to Mount Diablo she has an in-depth knowledge of students and a wide breadth of experiences with students of all ages a strong Foundation where she developed at Cornell University and again has worked as a school psychologist with school psychologist of the year in 2009 in Fairfield so soon and again just bringing a great well wealth of experience Catherine is known for working with students with significant

emotional needs and program design so we think this is going to be a great opportunity for us to have Catherine kinsella join us as a program specialist Madam president I would move that the board approved the appointment of Catherine kinsella as a program specialist for the special education department second okay we have a first and a second and that passes five zero zero zero so congratulations to the Catholic uh and another we happen to have two tonight special education program Specialists uh we're fortunate to bring forth the hopeful appointment of Lisa Tom and Lisa is here in the audience uh she's joining us again with a wide range of experience providing support and special education programming working with both preschool and elementary students uh found her support in supporting IEP teams ensuring success for all

students she served as a program specialist and as an elementary special day class teacher she has actually worked as a geologist as well this is something that we didn't talk but uh and as volunteer uh with her wife's high school math and science classes as well she's found her love for teaching and rewarding occasions where she again Works to help our special education students she's built steam Labs as well in her previous district and an instrumental in implementation of curriculum that meets the needs of both general education and special education students so we're thrilled to have Lisa Tom also join our special education department Madam president I move the board of Point Lisa Tom as program specialist for special education second dad okay okay so you said here yes yes I think I would like

to see you um so we're going to go to the vote and that passes five zero zero zero actually [Applause] so let me give you the drill yeah thank you so much for having me thank you you're president of the board board members and uh superintendent Dr Martinez I am really looking forward to working for the district than to serving our students and our communities here in Mount Pablo so thank you so much I appreciate it thank you very much foreign appointment for this evening is an educational consultation and behavior management Specialists working really in our general education population uh so one of the things that we've been talking about is again a number of students who are needing some additional supports and not necessarily every student requires special education services but again so we're

moving forward with this position we're pleased to bring forward Adriel Wong as that education consultation and behavior management specialist and Adriel is out in the audience there she is and she comes to us with 14 years of experience as a Clinical Director in advanced behavioral interventionist with children with autism spectrum disorders ranging from the ages of one and a half to 18 years old with applied behavioral analysis techniques she's very effective in training staff and delivering feedback while using behavior skills training to ensure Fidelity with the implementation of programs she brings a BS in Psychology magna laude from University honors in May 2007 from Catherine California Lutheran University now down in Southern California and in 2016 she earned her Masters in professional applied behavioral analysis from the Florida Institute of Technology so we're thrilled to

bring Adriel to our district she has a real passion for working with students and families and teachers and so we're really thrilled to be able to add her to our district Madam president I moved to approve the appointment of Adriel Wong to the position of educational consultation and behavior management specialist second I agree we have our first and second we'll load the vote and that passes five zero zero zero hey girl will come on up to say hi hi I'm Andrew Wong and I just wanted to say thank you so much I'm really looking forward to working for the district and just working with the kids and really helping out the teachers and the district with any needs that you guys have here really and just in general thank you so much okay thank you

painting free beads um free games just for people to like come and have a good time before heading into the game pretty much [Applause] oh good evening president turkey board members superintendent Dr Martinez members of the superintendent Council of Liberty Gardens my name is Acero Guevara and I am a representative from Ygnacio Valley High School so marching band has had a great season and they competed this weekend at the foothill review our football team is seven and two and last Friday was their senior night they did good and this week they will play their final game at Benicia and children's performed at Stanford and they performed with the cheerleaders during the game and as we speak we are having the Halloween spirit week as well as an appreciation to like the staff members so today

for example was pajama day so we called it zombie day and you also had to like uh high five any staff member you saw and tomorrow is which which is which so it's twin day and you get to bring you get to take a selfie with your favorite teacher or staff member and the Freshman leadership class is working on recognition day was which is a day in which we recognize the Warriors that have a 3.0 and higher so they've achieved better grades and we have a Club carnival on Halloween day which is also a good opportunity for each class to show like get feedback from the school um and we want to thank all our alumni for coming out and supporting our athletic programs and making our football games memorable thank you thank you foreign

good evening president Berkey members of the board superintendent Dr Martinez and the superintendents Council so uh we're from I'm Silas Andrade uh we're from the college now program and first off uh I'd like to thank those of you that attended the bowling project presentation and we took your feedback into consideration but unfortunately we've been busy but we will come back to that um for our senior classes as far as the they go They're going very well and our English class we've just recently started our Juvenile Justice unit and to kick that off we watched the historical fiction when they see us on Netflix and uh it's a great film I recommend it for everyone um for our Avid classes we are now filling out our college applications as we've just recently finished writing all of

our personal statements and we're taking one day out of the week to work with educational Talent search to fill out our FAFSA applications for economy we are working on our world series of innovation project in which we've been assigned into groups of three or four to come up with our own idea and uh as I stated last meeting the prize for first place is eighteen hundred dollars which we're eligible for uh one obstacle that every student on our program has been facing however are the fires as a lot of the students in our program their houses are out of power and the air quality on DVC is pretty bad at the moment okay and I'm going to talk to you about our juniors so right now our juniors are taking history of the U.S Junior

English and then Avid just like the seniors do also so right now in Avid they're learning about different career opportunities they have so they're doing tests to figure out which careers based off tests that they think will best suit them and then they can look into those careers themselves and be able to see what education they need to pursue those careers and if college is right for them or if they should become a journeyman or what they should do to be able to get that career and then right now they're also reading books on Native Americans LGBT Linux Asian Americans and women to find out their struggles for equality in English and that all culminates into a paper that they're going to write about the struggles of equality for a specific group that they choose

and they're having literature circles and discussing it in groups to better understand those struggles and in history they're also learning about those struggles and then they will make a monument for those struggles and propose a place and what to do with this and overall they're doing really well besides the power outages and fires thank you thank you very much good evening president thank you members of superintendent board members superintendent Dr Martinez members of superintendent Council and members of the audience my name is Melia Espinoza and I am vice president from Mount Diablo High School my name is Andrea Garcia and I'm the ASB president um I would first like to address the homecoming rally that took place on October 18th as mentioned before our famous classic Court performances were all great and the audience was

full of excitement the sphere was that took place before the homecoming rally continued to show school spirit the homecoming dance that took place in our cafeteria on October 19th was quite a success everyone talked about how the DJ did a great job and the dance itself was a success teachers came to the leadership room to congratulate us in person on all our hard work put into the dance students mentioned the fact that it had been one of the best dances in years um personally I really like the theme and I really like the decorations although we're still finding spider webs all over the place this is our costume contest on Halloween celebration and MBTA field day on Thursday we will be having on teachers will be having teachers judging the costume with the students participating

in the Halloween costume contest and on this Friday we will be setting up an altar in the cafeteria for Dia de los Muertos which is a holiday where um people can celebrate or remember their past um their loved ones senior portrait appointments have been set and will begin in November students are welcome to change the day if they aren't available on the day that's given to them MBTA field day is a day where 10th 11th and 12th graders in the medical and biotechnology Academy are able to build a teamwork cooperation and problem thinking skills while having fun it will be held in Baldwin Park which saves us a lot of expenses for transportation because it's right across the street the MBT seniors have been working on this for a month to meticulously plan the day

and ensure everyone has a great time they will be participating in a series of games that are meant to create new friendships and solidify professional Partnerships within the academy thank you okay thank you okay here we get everybody okay well thank you for waiting I know it's getting late so thank you very much for hanging in there we really appreciate it [Applause] um okay and we're gonna move on to board member reports Associates and um extra large you want to start and I recognize it's going to be a long night so I'll keep mine on the griefer side I think you know throughout our community we're faced with the challenges posed by fires the the wind and the erratic Communications from PG e which make it challenging and I think that has created a tremendous

pressure on our students our families our staff I know some people have questions as to why school was open today I think that you know first and foremost is the safety of our students and though some students might have the opportunity to stay home and be in a sheltered environment for many of our students being at our school sites is their best option and so we want to provide that as well as obviously pursuing our educational Mission and so I want to say uh thank you to the staff for all of their efforts today I always when families ask me I always say you you should look at the available information and make the best choice for your own student and make the decision based on that but our staff worked incredibly hard over the

weekend last week in preparation for today I think it went in many instances really well I think unfortunately at one of our schools at Northgate High School due to a plethora of issues it was a very very challenging day there I think that it's something that one we need to be accountable for to we need to learn from and three we need to do our absolute best to make sure something like that does not happen again I appreciate everyone's efforts on that um I think that you know much like all of my fellow board members um I think we're always impacted when we hear from our our teachers our parents as we did tonight earlier over at Monte Gardens and I think the challenge we face as a board is as our costs go up

and our available funds continue to shrink how do we stretch those those dollars and I I don't think there is any argument that we would like to do every single one of those things whether you know from a standpoint of have more nurses more Librarians more counselors reduce class sizes as well as provide a raise order to do just one of those things it will require Cuts in other areas and so those are the trade-offs that we face and I think that um in order for us to get to an agreement I think we're going to have to look long and hard at what the trade-offs are and um you know our community has been great about supporting us from a facility standpoint with both another measure C and measure measure J but pretty much

any agreement we come to is going to require more money from the state in order for that to be sustainable for our district and so that's going to require there are two possible uh ballot measures in November of 2020 one pushed by CTA one pushed by csba I think it would be challenging to have two I think hopefully that there's um an effort to get behind one of those measures and I think our community will have to come out in support of that because if at least one of those measures does not pass we will be facing some very very difficult choices and having some rather massive impacts on our community and it will impact the student our students in a way that none of us would want so we will have to work together

to make that happen so thank you you know I went to our leadership our speaker series I went to Mission Valley High School for the college fair I thank all the staff and and parents that helped plan both those events for our families I also went to the Charter School hearing and um it always saddens me when a group any group of people are out advocating for themselves and feel that one of the ways to do that is to downgrade other people I think you can always make your point without trying to bring somebody else down so that saddens me and um I didn't know that Mr Lawrence we're going to make the statement that he just made about the quandary we're in but I had read this last night we did lots of literature

this is the csba magazine we get and I highlighted this to read tonight and it says the call for higher salaries and smaller class sizes highlights one of the conjuries of educational leaders face as they try to meet teachers demands serve students and meet the responsibility as fiscal stewards smaller class sizes are popular with teachers and parents alike but fewer students in classroom means more classes which requires more teachers increased School site and district-wide expenditures on salary and amplifies the impact of any salary increase at the same time rapidly increasing health care costs skyrocketing pension obligations burgeoning costs for special education and a constant barrage of unfunded mandates created by new legislation eat away at limited Revenue to add to these difficulties for the first time in California's history the a number of school-aged children

is declining reducing enrollment and Associated Revenue in a manner that had not been felt recently believe me to all the teachers and that went home and parents that are frustrated we are doing the best we can by you but we have to balance the budget and we have to try to meet the needs of our students not just the students that are coming next year but the students that are right here today and we're facing some very hard decisions because every time we add a teacher and reduce class size we just increase the cut we have to make in the future so bear with us and I know you want to say do it fast do it fast but I'd rather do it smart thank you yes ma'am I want to um Echo some of

the comments that were made and uh I attended many of the meetings that were already um provided the parent advisory meeting at the district English learner advisory committee meeting we I also participated in two PTA meetings and had a meet PTA meeting at my home this morning the lcap speaker series was a great event where we received information about the food and nutrition services department and the delivery changes that will be happening and we all got to sample some of the great food items that are available in our cafeterias thank you to board member Lawrence for mentioning the full and fair funding um proposition initiative that was submitted to the Attorney General on Monday October 14th the name of it is the full and fair funding the Public School progress prosperity and accountability Act of

0422020. this would bring funding to K-12 education and community colleges and the estimated amount would be two thousand five hundred dollars per Ada for our students in California so we understand and appreciate the work that CTA has gone through to put prepare their Initiative for the ballot and personally I would vote for both of them so that we can have that much more revenue for our schools and for our communities as well the uh I also have been reading this some of the same material but Mrs Mason has been reading and in there I hope the rest of you are looking at some of the other articles including the role of the school board's attorney we are have had a great relationship with Mr shanky but I think it's always important to look at uh

new information it's probably not new information but just to refresh ourselves in that role and appreciate the legal services that we receive thank you um so a few of the things that I attended I was able to go to the lights on after school event which I know many of you did as well it was really exciting to see what it is that we're able to provide to students after the school day in so many of our schools particularly for families that couldn't afford to to do expensive programs and things like that after school um and so not only are we keeping kids safe but also an educated but also um a lot of fantastic opportunities from gardening to robotics to mindfulness really great great to see um I also experienced lights off during school

um my many of our electricity has been off since Saturday I know many of you are in the same boat and Northgate as well so uh definitely feeling the effects that three of our schools have been going through lately as well as the Northeast situation I did attend an education Roundtable with assembly member Rebecca Bauer Kahan last week and interestingly a few of the topics that came up were related to that one of the ideas for possible legislation if you like this idea send it to your to your to your State Assembly and Senators um was to realize that a lot of our school districts have solar panels um but we can't tap into that energy directly right because PG e and then we have to wait for it to come back and sometimes the

power is shut off um but if we were able to one one idea for legislation is that the state of the state provide one-time funds for school districts to purchase the battery and apparatus to be able to use the energy directly on the site I thought it's a very interesting idea there was also discussion about reimbursement for the Lost Ada that happens due to power shutoffs and air quality concerns so both I think interesting and important ideas as things move forward I want to also say thank you to all the teachers and staff and parents superintendent Fire Marshal who've dealt with all of the changing notifications from PG e and the weather and how everyone kept positive and kept students safe and especially to the firefighters that have been out there on the front lines

um I know that everyone worked hard today uh but I also know there was a lot of confusion and uncertainty out there in our community um we can do better we will do better um and the community can be a part of the solution um I think we need to think of ourselves as a learning organization so it's okay to admit that things didn't go as well as we wanted them to um and we can learn from our mistakes and make sure these things don't happen again and that we do better next time um a few ways that we can handle some of some of the new situations around safety with emergency preparedness planning one is measure J you know when we were up knocking on doors for measure J that was for safety right

um and so if our facilities need something whether it's a backup generator or extra lighting whatever the case may be I think we should really look at our measure J funds and make sure that we're prioritizing those safety issues um and also our site emergency plans I know every site has I was when I was a parent on site Council you know for the elementary school we read through and we approved every year our site councils approve emergency plans at our schools um but they're you know large documents many pages printed out um and I think the missing piece is communicating those plans specifically to the community so the parents know do I send my kid to school with a flashlight you know what is lunch going to be served all of those various things

what happens if you know the PA system doesn't work right so those are all things I know but that the district will be working on um and uh lastly I just want to say after all the people that spoke at public comment tonight um it is heartening that so many people care about our schools our parents our teachers um we are we all want the same thing and I think I've heard that hear from my fellow board members here tonight as well uh we would love to provide everything that we think our students deserve I hope that every single one of those voices can be heard at the state level as well um please send your same the same stories that you just told us get on your computer tonight tomorrow send it to your

State Assembly members and your state senators they need to hear these stories because State funding that is the majority of our funding we the local school board don't have control over that the only other thing we could consider that the community could bring to us is uh you know a local parcel text that is one other way that school districts handle not having State funding is to diversify the sources of funding and say okay you know we have an Education Foundation and local funding local parcel tax is something that we could consider if there's community support for it so we need to be hearing if there is going to be any support for something like that thank you great thank you very much so I'm not going to repeat the same meeting so I just

um if there is one that wasn't mentioned at um Ms mayo and I um are on what's called task force and called education test so pleasant hill task force this is something that was formed some time ago um for two board members to meet with two city council members and Pleasant Hill along with our superintendent and to kind of focus in on some particular care issues of working together so we just had that meeting it was the first time for Dr Martinez to have experience and did a great job of course we're very happy he was there so that work continues and I just want to share a couple a couple announcements that things that I thought were particularly important and interesting one is um the early it's called Early Childhood Mental Health Community Forum

it's on Saturday November 2nd it's a contrast to behavioral health and also first five Contra Costa that are putting it on it's a Pittsburgh senior centers 10 a.m to 1 p.m registration starts at 9 30. so it's a an opportunity for a discussion in-depth discussion around identifying mental health possibilities or issues in young children so and then the other one that we all got is a celebration of success as our own celebration of student to recognize students nominated by their school side to have demonstrated out sex outstanding success from our special ed students so usually we're all there in four so I'm sure we will be this is November 6 Concord High School multi-use room social Gathering 6 30 in the awards ceremony seven it's a very heartwarming and so now we're going to move

on to the superintendence report and and we actually have a public comment for this card so Mr schneidel would you like to speak sure so he good evening board members superintendent Martinez Commando my name is Jim Shadow I'm the executive director over at Clayton Valley uh come tonight just with a delivery for you as well as some additional information hopefully give some context for Clayton Valley's desired relationship with the district in regards to the delivery so I've got a check here for you guys this is 925 000 and change uh to you all and so I'm hoping to give this to the superintendent after I'm going to reply comment um for you guys and there's a letter that comes with this check and it's from our legal counsel and it does address some of the

things that we got from your legal counsel and so I just wanted to make sure that there are some pieces of this payment that are very clear in the letter that we're making to you this is not mean that the process that the case is proceeding with is stopping we're going to let that play out or we did you guys send us a letter we sent you a settlement back that had a time frame on it we heard nothing back in terms of a response so that that expired we'd love to get this settled though outside of attorney fees and legal fees and things like that and I do appreciate the superintendent making time last week for myself on our board chair so thank you for that very much and just moving forward I think

we want to have as much open communication as possible I do appreciate member Mayo you responded to my email and it was way back in November of 2018 but I do appreciate your response to that um and I do think that open communication and direct communication is going to be a good way to move forward if we can for Resolutions and letters of Correspondence and newsletters are not directly to us unfortunately sometimes they're inaccurate or they actually raise more questions I know that your actual document that you provided to the county said we cannot verify all these concerns we're here to answer any questions or provide you whatever information there is we're an open book we're a public entity we can without you doing a PRI request we'll just give you the information you have

our kids for the most part for their first nine years of their education so it's our and our benefit and our interest to have you guys be as strong as possible and we hope to have the same relationship I did look back in my email since I came into this position in August of 2018 I've actually sent over 30 emails or public comments or phone calls or in-person meetings to try to get this issue resolved including 12 individual Communications to your former former in-house legal counsel now Mr shanky someone else I know you interviewed for that position either last week or this week I do hope that the new person in that position will be allowed to be more communicative with us that way you're not spending dollars on an outside legal council in terms

of that hourly rate we want to get this resolved hopefully this check is a step in the right direction and I'll email the letter that's in here as well to the superintendent tomorrow so he has a soft copy of that he could share that with you as well so with that being said um hopefully I can give this to you if that's okay or I can give it to your secretary or are you saying that the receipt of the check is contingent on what's on the letter oh the check is for you no matter what the letter just lays out some of the conditions for uh for the funds so it's it's yours to do what you want with I know it's not a very big chunk of money compared to your overall budget but

in terms of the dollars that we're owing I know the headline and the paper said 850 000 something dollars if you tack on the 60 whatever thousand dollars of Interest that's where the 925 came from um if you take the 160 000 we paid every year for eight years plus that that's over 2.2 million dollars that Clayton Valley has paid to Mount Diablo Unified um and we just want to get this resolved so that we're not spending money on lawyers and negotiations going back and forth year over year our Charter will be renewed for five years in my old District we would just have a five-year lease because it just made sense and you didn't have to spend any money any time on it year after year and we cut the check to the district

every year on time and they gave us the bill on time and we just proceeded that way so that's something we'd hoped to be doing was in our settlement office I believe you all received it and then another superintendent as shared that we raised I think so so um yeah but the the money cashed it tomorrow or have whatever your process is and we couldn't get a bigger check I thought that would be a little bit but it's a big number on a small chapter thank you thank you thank you well thank you uh director shebel I mean it was a pleasure meeting with you and sitting down and having conversations about again our students in this community we think it's important to continue to do that and again my office is seeking to communicate

with everybody who cares about our kids we have a lot of to do and again even our Pleasant Hill folks we're kind of like we need to meet and it's like I know everybody but things as we can get to them again we have had a very very busy day A very busy weekend trying to work towards again we've talked about this the circumstances that trying to solve a puzzle with pieces that continue to change from PG e and the best information that we can uh we I spent some time on Sunday communicating with the county superintendent and superintendents throughout Contra Costa County uh coordinating with the information that we had from PG e the Contra Costa County Office of Emergency Services we did decide given the information that we had that we were going

to attempt out of Safety and Security is board member Lawrence spoke about keeping our schools open today we did have three schools without power and one unfortunately based under again the circumstances of the day and working directly with the fire marshal we did make a decision in collaboration that we couldn't sustain the best safety we thought throughout the day so we did close the school midday again the information that we have is really changing almost hourly and how many times it gets out there in Facebook the other concern is not just without power but again the air quality going back you know last year and even the years before we've all learned more about the aqi than probably we ever thought we'd want to know and yet the information has to continually be reviewed for

the process of securing safety of our students so one of the things that we did is made sure that all of our school sites all of our departments all of our you know people who manage our employees and students uh had information regarding the aqi knew how to get on the sites to monitor what was happening for the maps there are several different places to go we are recommending again the Bay Area Air Management District they're the folks that our county is relying on if our county is relying on them if our police authorities fire authorities are relying on them we're trying to use one General reference so that's the information that we're using to again then take the suggestions that we have for air quality and implemented our school sites I know even early

in the morning people thought well it's green and it's okay and our kids can do these activities but we're trying to be extremely cautious and sensitive to limit those outside activities when the quality of the air is not acceptable range for our students again I'm just going to thank again all of our school staffs across the district but especially again our Northgate Community our Walnut Acres Community and our Foothill Middle School Community those three schools did not have power today but they were caring for students once again our food and nutrition services department showed up with a great prepared plan with meals that they were serving out of the refrigerated trucks which had passed mustard the week and a half before through the County Services as well and so we know that they were out

today trying to shut down other schools but we had a plan that was meeting the needs of our students not in our district by the way across the county so again what we know at this moment and somebody checked the time power is on at all of our schools right now we know that we have teams out there running the air getting circulated through the systems checking again to make sure everything is okay so I'm going to say it we plan on having school tomorrow are in any unforeseen circumstances schools can run educational programs without power it can happen superintendents across the state are doing this at this point the difficulties start to come when we have multiple days of power outages because that creates a significant impact on our campuses on the food supply

on the emergency lights when you look at our exit light it's on right now but they don't stay on forever when the power of lights when the power goes off for a certain amount of time and they have to regenerate when the power comes back on so again very minute details that we're looking at and we understand now I'm going to say it again families have to make a decision about their children their safety if they feel they do need to keep students home for their own security and safety it's not our desire or intent to punish any child from that set of circumstance and if we do feel that we cannot support the Safety and Security we'll make different decisions about our schools so one extremely positive thing from last night and I don't

think anybody mentioned this one you might not have known which is kind of one of our communication things but we had a Special Olympics program at Concord High School and we had included 25 different districts or different schools to come to hundreds of students who are participating in soccer activities with our Avid leadership teams of Concord High School taking care of students guiding them through games it was just a wonderful Friday morning experience and again even as we were kind of prepping those things are happening every day as so many of our schools it's our teachers our support staff our administrators are leading they are leading every day and they're leading with resilience to help those students be prepared and get through to the next day with our family support so I'm going to leave

it there at this point but thank you okay thank you very much okay we're going to go into recognitions and resolutions and we have 14.1 thank you potential approval resolution number 19-20-24 recognizing November as Native American Heritage Month so yes Native American Heritage punch this is something that has again uh come before this board in previous years and so we'd like to bring it back uh simply recognizing and I won't read the entire thing but that the country was home to generations of native people long before the arrival of European explorers and each of these tribes had a unique and vibrant culture as well as a system of social order and it goes on to talk about again the rich level of educational curriculum that we have and the process that is in our kindergarten

through 12th grade that focuses on again our American Heritage Month Native American Heritage Month throughout the process promotion Madam president I would move that the board approved resolution number 19 20-24 in recognition of November as native Amer igment we'll send it that thank you we have first in a second in a comments we're going to vote and that passes five zero zero zero thank you yay from 14.2 is reviewing potential further approval of resolution number 19 20-30 proclaiming November 3rd through 9th 2019 as banned books actually I'm sorry I'll refer to Dr Martinez well and I was going to introduce you so again at this particular resolution was brought forward by board member Lawrence again but it's a important structure where we take a look at again the freedoms within our democracy about reading and

really the importance of not limiting access to materials for students but important rewards thank you and I think this is one um I've been proud every single year when our board has unanimously supported this and I think now today as we see a diminishment of the press that we see a diminishment of um different voices when we see foreign countries influencing our elections and so I think the ability to have a wide variety of thoughts and to help our students develop their critical thinking skills and and not indoctrinating them into any one way of thinking but instead exposing them to many ideas and allowing them to develop their own thoughts and ideas is part of it makes what makes a vibrant democracy and society and so I would hope the board would go ahead and

approve item 14.2 the approval of resolution in favor of banned books week promotion yeah it is okay first and a second without further discussion we'll go to the vote and that passes five zero zero zero great thank you thank you okay we are now at the um consent agenda items listed under consent agenda are considered routine and will be approved adopted by a single motion there'll be no separate discussion of these items however any item may be removed from the consent agenda on the request of any member of the board and acted upon separately one comment um I um was interested in further detail about agenda item 1611 and so I just told superintendent would be able to provide that just some of the detail of the grant would be a welcome information we've always

supported the CTE Grant applications so perhaps next time more information if you don't want to pull it no I just want to pull it okay but yeah where do you think okay and the information that we did provide to the questions there's a link in there I don't know if you got that this evening write it before the meeting was started okay so I haven't had a chance to read yeah exactly okay thank you okay all right I have a motion for the consent agenda Madam president I would think that the board approved item 16.1 the consent agenda as presented okay do we have a second second okay yeah first and second we'll go vote and that passes five zero zero zero thank you business action item item number one public hearing and Adoption of

resolution number 19 20-20 8 resolution of the governing board folks power from Power's Out we're just recommending that the Contra Costa County committee and School District organization approve and established trustee areas from which the Mount Diablo Unified School District trustee will be elected by a trustee area election process and resolution number 19-20-29 resolution designating election years for trustees areas areas whatever yes we do have Larry Bird child here who's been doing a lot of work for us on this issue who would give us a little synopsis again tonight for the synopsis president of Turkey members of the board by Dr Martinez um this could be the end of our many meetings together um over the last several months but we've gone from our previous public hearings back in May and June um the maps that

we've drawn public hearings we've held on the maps and so this would be our third and potentially final public hearing on the map scenarios and give you a chance to discuss and select a map and sequencing to forward to the county committee on School District organization which I believe is already tentatively scheduled to meet here on November 13th um to review the district's petition should it be approved tonight and the county would then either the final stop on each little process and I'm not very loud I'm apologize and there it is I will lean in um a little bit more um again the criteria in in selecting trustee areas or creative trusty areas roughly equal in terms of total population compliance with Federal Voting Rights Act Compact and contiguous keeping communities of Interest together using

man-made or natural geographic features those are all the considerations that we've talked about over these these many meetings the district demographics again 250 371 people as of the 2010 census so by roughly equal areas of fifty thousand people and you can see the ethnic breakdown there on total population and population 18 and over uh we also have the citizen voting age population here um again highlighting the different protected classes and the map on the right hand side highlighting the concentration of the Latino citizen voting age population within the district um through this process we've narrowed it down to the three scenarios that you have in front of you tonight starting with paint and all three scenarios area one is yellow two is green three is red four is blue five is purple oh they're telling

you where all those areas are you're more than familiar with that talks about the sequencing and then I think last meeting gave Direction in terms of those sequencing of the elections um in the scenarios that would be in areas three and five all situations in 2020 and areas one two and four in 2022 the direction from the last meeting but this again is scenario pink highlighting that map we've got all the demographic information highlighting that we create one area in the monument Corridor that is a non-white majority citizen voting age population area because again it's not possible to create a majority Latino or majority any in particular or particular protective class area we also have additional demographic data on AIDS breakdowns in the different trustee areas renter renters versus home ownership as well as income

information that you can see across the different scenarios and areas in each scenario um and then finally School attendance batteries that you have had all this information multiple times so I'm just going to freeze on through it this is scenario purple a little bit different than pink a little more compact in in the center of the district in that Monument Corridor trustee area area three so that's one of the differences but you know overall Shades overall themes very similar between pink and purple it's just a slightly different way of achieving similar results that you can see there similar election sequencing as we had in scenario pink similar demographics again the monument Corridor area area three having the non-white majorities and some voting age population area we can see the age ranges home ownership and that

information is there as well as household income information and School attendance foundries as well and then strangely named purple a scenario just a little bit of an offshoot of scenario purple the main feature that's different about purple a is from purple bless you is that we were able to get a high school facility in each of the five trustee areas and by doing so that moved area three down to the Ignacio Valley High School campus and moved area one over to take in Mount Diablo High School's campus so it's just kind of Twisted things a little bit we'll see again to to accomplish that but pretty similar in terms of the demographics to purple non-a so that's purple a in terms of having a majority non-white citizen voting age population in area three again and

very similar demographics to scenario purple and hopefully I didn't bore you all too much with that repetitive information but just to give people a little bit of background before the public hearing and if there's any questions afterwards I'd be happy to answer it thank you so um we have one comment card for this Mr Rafferty is going to be back nope okay okay so now we just opened up the public comment right if there are any other I mean anybody would like to make comments and so we just now have more discussion it's on where is I just wanted to indicate to you that as you have on your agenda you have two resolutions to consider tonight the first one is number 28 19 20 28. relating to picking an area we have to pick

an area I'll have to fill in the blank and then we'll approve it or not approve it or just give me an idea of which one you want to select I did want to say well the Mr Rafferty was here earlier apparently he could not make it back I did have a discussion with him and he is expressed again like he expressed last time he's very happy with the process that you undertook here in this and I want to thank person who worked most diligently on this is Mr verchaugh has done a wonderful job it's provided all the information we have reached out to the communities we have tried to prevent provide as much information as we can for you all to go for a go towards a election by trustee area there will be

a new world for this particular District as it is for many districts in California and Larry and I both hope that you select a good area and hope you have good success with your elections I like purple a and I heard at the last public hearing that several members of the public as well liked purple a so that would be my preference same in I will make a motion for purple a second we have any other comments I would agree I think that that is what we heard the most from the community and it represents in terms of also creating two majority minority areas which was one of the goals of the fact I just want to acknowledge that we have one person that holds up the back wall that's in favor of pink but

I think the board majority is appropriate free Clayton thank you Mr Langley you understand now once we vote we can stop calling it purple a right yeah unfortunately it's what we have to transmit to the county yeah I would ask that the board actually adopt the resolution say it that way okay then I make a motion that we adopt resolution 19 20 28. towards the areas to um name purple a as our choice better yes okay we have a first and a second there was no other comment we'll go to the vote and that passes five zero zero zero we do have another resolution that was sort of a tag worm for this resolution concerning the election sequencing since it was not a separate item it would have to have a voice quote on that

oh you actually didn't adopt election sequencing with the adoption of purple a because there is an election sequencing on that map but we've been recommended uh by the partners in my firm that do a lot of this work that you adopt the separate resolutions of the county committee's clear on your recommendation as to what areas would go first as we've discussed that the number of these meetings and at the last meeting reflects Area 3 and area five both of which do not have a court resident trustee at this point um I think it's we recommend that to you one because of area three being a majority minority District I've had some influence on the election and I can have another benefit of area five is is primarily a comfort district and he will have a

Concord board member after the next election which has been a while we recommend those to you and ask you that if you adopt uh resolution 1920-29 with the insertion of areas three and five for November 2020 and areas one two and four whatever November 27th so that would be option one correct yes Madam president my move that we approved resolution number 1920-29 and calling for the election to occur in areas three and five in November 2020 and areas one two and four for November 2022. um and so I I support this sequencing but I do want to say I um I think how we arrived at it I think there have been some um mistakes in how we've arrived at it and I I think one of the things that I want to make really

clear is that under election law this idea that um any areas will have no representation is really Incorrect and um I I think it's one not representative of our current board and two I think it's a misinterpretation of the law um and so I think how we have actually uh expressed this is just not been correct I think we've arrived at the right decision but um I think the process could have been better and I do want to stress that um come 2021 every person in our district will still have representation it will be from of our board members but that there will be no area left without representation so I just wanted to share that before but I appreciate that I agree with that thank you um any other comments just to again um

I think I I liked it because it was important that those areas that feel feel that they don't have representation will have someone from that area and the other thing that I thought was important with our new superintendent to have the smaller turnover of the board now and the larger turnover of the board later in order to provide the experience and support that he needs so that was my consideration for this one that's assuming it's going to be a turnover in the next the next one though oh that's true you could move to conquer yeah that whoever is elected is the next time around we need to emphasize as a team that we all represent the whole district and we always will um the only thing that this process is doing is to ensure that

the people who sit at this table are living in various parts of the district so that they hopefully have very perspectives um so we need a voicemail okay okay the comments and we'll go to the vote Mr Lawrence I vote Yes Ms Mason yes my name is Mayo yes and miss cam yes and Mr Keith yes as well so it passes five zero zero zero I I personally want to thank you for your patience during this process it has since the end of March we have hooked up it feels like the Baton death march to be honest with you but I think we've reached a good result through all and I wish you my success in which one of the election thank you and I'm sure that was going to be Larry it was clapping

when we he's on to the next District I would like to thank all of the community community that can't out to any of our meetings the email that called that participated in and hopefully that that means that when November comes around people are not surprised by what's on their ballot to educate people about the process I just want to say this is a monumentous decision for all of us so it's been a lot of work and study and I appreciate every board members involved look at all with the staff involvement because it affects staff as well and uh important decision thank you for your cooperation and your effort okay 19.2 review and potential approval for physical education course of study revisions to high school physical education High School Personal Fitness designs for information about science

on for Action tonight make a motion to approve the physical education course of steady revisions to high school physical education and high school Personal Fitness second first in a second I just want to say I sent this out to individuals who have contacted me about PE over the last what five or ten years and I am amazed that there hasn't been um more comment more emails regarding this so um congratulations to staff the folks see happy about it can you see it later and that passes five zero zero zero thank you foreign item 19.3 review and potential approval of the Williams quarterly report for October 31st 2019. make a motion to approve the ratification of the Williams quarterly summary report October 31st 2019. second the first and second there are no comments we'll go to

the vote passes five zero zero zero thank you 19.4 review of potential approval of the new membership application for Community advisory committee no just please approve them should we approve uh 19.4 item number four yeah Lisa buffum Kendra Sullivan and Jessica Zane for the community advisory committee yeah I'm missing one three applications online it's okay we'll get get them on the next day um okay we have a first and a second and I really appreciated reading these they're people are so enthusiastic and ready to help it's very exciting to see been attending the CAC meetings meetings part of things requirements so they're familiar with the work of the committee thank you that passes five zero zero zero thank you thank you okay 19.5 review and potential approvals and new director of risk management and safety

job description this is on for information and action so I apologize I did not see the response to some questions that I had submitted um so I only have my questions it seemed as though our previous job descriptions for risk management and safety had more to do with the facilities matters and I noticed that this job discretion had additional items so I was hoping for some explanation and rationale sure I can provide that so one of the things that we've been taking a look at in the form of a course the safety of our students we've been talking about this this board has actually had a safety coordinator position on the books for some time I believe the position was flown they didn't find somebody and then they've had in essence a consultant doing some

work in the area not necessarily an expert in that realm the other thing that's not lost upon me is that even Within These 11 weeks the district does not have a true sustainable plan for helping really our employees there's pockets of things happening in the sense of our workers comp we do have somebody working on that but we don't have that full coordination between the larger Insurance oversight group that we work with where there are a number of programs to help our employees connect through those programs or make some changes within our structures that in my opinion is risk management not necessarily just a financial side of risk management but it's doing things differently so that we can help our employees with training we can help our employees with program we can help our employees

ensure that our information about benefits is all directly relatable to them that's another side of the risk management so that we're mitigating work that's happening sometimes in our workers comp Arena sometimes with liability issues and sometimes that are handled within our legal structure the broader change that we're looking to do as we're reforming our Legal Group and again and we appreciate that Larry has been working with us in some form but he's not here all the time we really do need to have that associate general counsel that is part of our team but this new director will in essence be working with the coordination of that legal person our Administrative Assistant within the department and the benefits team so we're really kind of creating this broader team looking at our site safety and coordinating our

training and our entire process so this is using some of the funds that we actually have but redesigning said we're going to get more response I hope in a sense doing that coordination of our district-wide safety plans as well so but we need the people really are people to be able to do this work and work with the investment that we're making in the uh the architectural reviews and Designs so it's a little bit more of an in-depth process but we see this as really helping us move forward so um I appreciate the explanation and it a person that is hired in this position is going to have to have a very broad experience especially if you're going into the legal issues and each of the claims and investigations of you know benefits paying claims

and benefits I presume it's also the back to work will that be included in this if that wasn't defined necessarily but it's a component of it absolute okay and then um the eligibility of benefits reviews contact language and results disputes so there's um that's within the employee benefits section normally we think of as dispute resolution as being within special education so that's a different the final one that what I had a question about it said evaluates the performance of staff and directs needed training is that for staff that may be within that department or is that for staff district-wide it'll be both because the super Mission will more than likely have the current workers comp person we understand that person is leaving so we're going to take a look at that position which will work

in coordination with this individual really more of a direction rather than being in Human Resources at this point the benefit side will also be again coordinating with this person so we'll have it together that the benefits are on one side the workers comp on the other in the overall mitigation of the risk involved in both is being coordinated person the training aspect will be coordinating then again the training that we do for employees slips trips falls that type of training the mandated reporter training that everybody has to do rather than having it in different departments this person can coordinate with those different folks but we'll have one set location one set process that'll help us all get the training that we need in a consistent process working with the Departments and meeting timelines then too

absolutely and then uh the salary it was listed as salary range 18 can you provide the range I apologize I believe off the top of my head and I know our HR person had to leave I think it's roughly within the it's the director range for most of our other directors director of Child Nutrition our classified Direction directors so we're approximately 15 000 more than what the safety coordinator position was is it's an approximation but I can get you the exact data on our salary schedule that answers these questions I know in other public agencies it's very common to have all of these under one umbrella because they do all mesh together so I would move to approve the new director of risk management and safety job description okay if we have a first in

a second and there's no other questions I just want to say I really appreciate the way that you're looking at our systems as a whole and how to really coordinate because that's that's we saw it in action today there are places where we can do better and this is one way that's going to get us there I appreciate that and that passes five zero zero zero there we go 19.6 review and potential approval of the opportunity for public response to the initial successor agreement proposal for Mount Diablo psychologists and dspa and mount Abney Unified School District this is not for action we have no cards for comment s no I said we have no cards no cards have been submitted Madam chair okay so thank you um I would move that we accept the proposals

as presented second okay we have our first time second we'll move on to um and that passes five zero zero zero thank you 19.7 uh review and potential approval of the revised instructional program specialist categorical programs site-based job description this is all for action make a motion to approve the revision of the job description for instructional programs Specialists categorical programs site based second okay remember first in a second there's no other questions or on and that passes five zero zero zero thank you so Madam president um in a shocking turn of events I I will uh um propose a meeting extension um and and I'll give a little context that the board will be going back into closed session and having discussions regarding negotiations I think um you want to make sure that we give

that the absolute maximum time that it needs so I would propose a median extension to 1am that is a shocking Revolution second I'm not saying we have to stay that long but I just want to make sure that yeah first and a second until 1am is that even legal to go to the next day lyrics oh yeah if you give me a bad time thank you we all are here to do what it takes and then s is five zero zero zero so we do have um some documents assignment I'll bring them down here [Applause] that's it we are adjourned some of our newer members of our audience don't understand the humor I don't understand
