Good evening. Welcome to Zoning Board of Appeals and Adjustments meeting for March 4th, 2026. May we have a roll call? Sure. Member DeSanto? Here. Member Gillin? Here. Member McDonald? Here. Member Shimchuk? Here. Member Trippiano? Here. Member Duran, Flaxman, Olsen, and Weinklau ask to be excused. You've all received a copy of the last minutes. Is there a motion to approve? Motion to approve. I'll second. Motion to support. All in favor? Aye. All right. We have one appeal this evening. So we will read the appeal and then you'll have the opportunity to speak to your appeal. It's appeal number 3435. David Mendez, owner and appellant, has appealed to the Zoning Board of Appeals and Adjustments for the City of Wyandotte for a concrete permit for a new driveway at 1528 Davis. Wyandotte, Michigan, lots 530 and the
east half of lot 531. Also the south half adjacent vacant alley. Also west half adjacent vacant alley, Shore Grove subdivision in an RA zoning district where the proposed conflicts with section 190.324 of the Wyandotte zoning ordinance. Section 190.324 off street parking may be located within a side or rear yard. Off street parking shall not be permitted in a front yard in order to accommodate this requirement. The driveway must extend 20 feet minimum beyond the front of a home. The appellant is proposing to remove and replace the asphalt driveway 12 feet beyond the front yard. Is there anyone here to speak to this appeal? Please state your name and address. Hi, my name is Dave Mendez. I live at 1528 Davis Street and I'm requesting this variance. This would be a re-approval of a variance that
this board awarded me back in 24 and we weren't able to do the work for a couple of reasons. So the request is exactly the same as it was in 24 except for the fact that now my neighbor has a fence along his rear yard which is my side yard that abuts my driveway which won't affect my driveway at all. All it does is even more enhance the fact that nobody can see my driveway from 15th Street now at all because it's a solid fence. All the other reasons are exactly the same. We'd have to move our fence 8 feet back into our yard which would put our side door not in our backyard which would be a challenge for us and our dog and I consider it a safety or a security value to
have my side door within that fence, within that fenced yard. Other than that, we would have to remove some stamped concrete that was placed inside my backyard behind that fence that would have to be moved with the gate. We'd have to move some flower beds. Also, my sewer tap would be underneath the cement which I know is maybe not a big concern but if we ever had to do work on that my tap comes right out of my house on the side there would be underneath the new concrete if we ever had to do any repair work on my tap we'd have to possibly rip that cement up. I do have the, as I mentioned before I don't know that I provided you with a photo but I can park both of my vehicles in
the driveway and still have about 30 inches off the rear bumper before the sidewalk so we're not impeding foot traffic down the sidewalk. Let's see what else I might be able to explain to you. I don't know, I know one gentleman was over today I think you actually came over the last time in 24 and looked at it so nothing's changed except for that new fence from my neighbor which I said probably more enhances the fact that nobody's going to see our vehicles parked in the driveway which I realize is you want cars off the street and up into the driveway and not visible I think is the idea from neighbor's porches but I think since this variance was approved once I'm hoping that you'll approve it again. Alright, well thank you for that. We'll
open up to the board for questions. No, not really. No, I'm good, thanks. Alright, so then we'll go ahead and close the public portion and we'll entertain a motion. Make a motion to approve. Alright, we have a motion to approve is there support? I'll support. Motion and support. Any discussion? The fence kind of sold it for me that I don't know if you saw there's a six foot fence there. It's really not going to be a my problem with these is the aesthetic of the neighborhood and everybody's got there but with that fence there it really doesn't make a difference so. Well and I just clearly see the hardship with the sewer tap, the tree, door placement I think this one meets meets the intent of the ordinance. Alright, so can we have a roll
call? Sure. Member DeSanto? Yes. Member Gillen? Yes. Member MacDonald? Yes. Member Shimshonk? Yes. Member Trippiano? Yes. Alright. Thank you very much. Motion passes. You'll be able to check with the engineering department in about three business days. Three business days? There'll be a letter I think is what I got last time. Good. Then I can get my contractor lined up for the summer. Thanks. Appreciate it. Thanks for your time. Easy night tonight, huh? Yeah. Thank you. I forgot to mention we did receive one communication that was in favor of that appeal. I have a motion to place all communications on file. So moved. Alright. All in favor? Aye. And we do not have any we have not received any appeals for our next meeting in March. So that meeting will be canceled and our next meeting
will be May 6th. If there is nothing else to come before us we'll entertain a motion to adjourn. Motion to adjourn. Not the shortest.
