002agenda along with backup materials at least 24 hours prior to the meeting and have time to review and consider all items prior to the agenda being adopted members of the governing board our audience may ask that an item be removed from the consent agenda and brought to the floor for discussion at the appropriate place on the agenda i would like to offer the agenda as posted thank you dr bales does any member of the ward wish to move anything from the consent agenda does any member of the audience seeing none miss mature may we have a motion so moved excuse me mrs brown sorry thank you thank you for remembering all those in favor please say aye aye aye any opposed motion passes unanimously next on the agenda is governing board statements anybody mrs bacon

003um i just wanted to talk a little bit about what is happening in the district as it relates to our substitute crisis there's a lack of substitutes across the nation and across arizona and um two weeks ago our certified staff not assigned to a school including dr bales and his leadership team have filled open sub-positions so that students can have a consistent teacher during the day since inception this program has covered over 100 open sub-positions in our schools the sub rate fill in other words we get as many we only get 71 of the number of subs that we need each day in our schools in addition to giving students a qualified teacher for the day the program has reinforced for our teachers and students that they are the priority as we work hard to

004address the substitute issue in our district if you want to help call our hr department and they can direct you on how to obtain a substitute certificate for a clock to be a classroom substitute and it's not just our certified staff that are stepping up our support staff or esps have recently district level esps not assigned to a school have started to fill esp vacancies in our schools their presence helps the school run more smoothly and makes conditions for students and teachers more conductive to learning and teaching this is the first week providing esp vacancies and so far 75 vacancies have been filled the importance of our esp staff cannot be overstated and we are fortunate to have a group of professionals in our district who are committed to doing the right thing for students

005i want to thank everyone who has been doing this it makes such a difference in the schools and um your commitment to our teachers and to our students is noticed so thank you thank you this is bacon okay um i just want to say i hope everyone here sticks around for dr bale's superintendent comments um we're seeing some pretty interesting numbers in terms of code cases he's going to talk to us about very encouraging next on the agenda is call to the public as we have no awards or recognitions today and i'd like to read a statement because our meetings are made available to a virtual audience paradise valley unified school district has implemented a process to collect virtual public comments members of the public wishing to submit these comments to the governing board for

006this meeting were able to do so by completing the public comment form located on the home page of the district's website in order to be included in tonight's meeting members of the public were encouraged to complete the public comment form by noon today it is important to note all comments related to board agenda items that were received by today's noon deadline were provided to all governing board members and to the superintendent's office in advance of tonight's meeting these comments will not be read aloud during the meeting we'd like to thank our community for voicing their thoughts and providing comments for tonight's meeting we received a total of two comment submissions members of public present at this meeting wishing to address the board on items not listed on the agenda completed speaker cards to be recognized

007during call to the public due to arizona open meeting law the governing board cannot discuss or take any action on items not listed on the agenda we did not receive a lot of cards so each speaker will have three minutes for their remarks members of the public who have asked to speak on agenda items will be recognized to do so at the appropriate time during the meeting and again we'll have three minutes for their remarks we appreciate your input but please understand that the board members may direct questions or comment to staff and other members of the board i will call on you but for the record we need you to please state your first and last name prior to sharing your comment the point of this and every board meeting is to accomplish the

008business at hand and to be able to do so openly and collaboratively to that end everyone attending the board meeting whether speaking to the board or not is expected to observe our meeting rules as well as rules of politeness propriety decorum and good conduct and we thank you in advance for doing so the first card i have is from wendy muller this is my third time speaking to the board about the discriminatory quarantine policy that is in place i'm asking the board to kindly revise the policy to either one to quarantine all close contacts regardless of their vaccination status or mask wearing status to make it fair or to only quarantine the sick covid19 positive case this policy as it stands now is creating an atmosphere of second-class citizens in our schools it is putting

009undue stress on the teachers administrators parents and students the schools are now becoming the health police and children are missing out on education my son was recently quarantined for being exposed the school could not even tell me where he was exposed and then my son internalized this experience by asking me why does the school hate me he not only missed out you know on chemistry class he missed out on um welding which he thoroughly enjoys and that's something that he cannot make up being gone for five days as a well child we do not quarantine for lice chickenpox the flu pneumonia measles or mumps so after a year of trying to stop the spread of covet 19 it's obvious we cannot and we need to live with it i say only either quarantine the sick

010or let the rules apply to everybody regardless of their vaccination status because it's becoming obvio also clear coming out in the studies that even the positive coven 19 patients are also contracting covid so i i think we need to be fair about this policy thank you the next card is from lisa patchett hi everybody i've never spoke at a meeting before um i used to uh volunteer at mercury mine for nine years i've been to board meetings a few times but i'm here to discuss a quarantine as well and i'm going to give you an example of what's going on the school posts the coveted cases but it doesn't post how many students have been quarantined it does not post how many quarantine students have tested positive i want to know who's responsible for coordinating

011these statistics where is the oversight committee because my son has been quarantined and let me and this is going to be very important my son has been quarantined twice in august there were 16 days of school my son was quarantined for 10 of those 16 days 10. he's been in school for six days in august september 17 days of school in september my son has been quarantined for sitting next to somebody who is positive him not sick not positive nothing so for 17 days of school my son is going to miss 10 of those days so my son has been in school for 12 days this year 12 days i want that to sink into everybody's head here 12 days paradise valley school is failing to provide an education for my son for this covet

012hysteria and and i've had it something's got to be done about that people are masked unmasked vaccinated unvaccinated and it's it's it's ridiculous i want that to sit in my son six days six days in august seven days in september i wonder what september is going to bring thank you the next card is from nicole clootwick hi i'm nicole clipwick um okay so i wasn't gonna talk here and then i found out something today and i was um a little aghast um so we all know that the um asba is filed a lawsuit um challenging the law that puts student masking into the parents hands and prevents schools and school boards from um from mandating masks so first i found out that we have a conflict of interest right we have a member of our

013school board who is employed by asba which is questionable at best and then i found out that the arizona board of something has decided to interpret the federal law that dictates how esser funds are distributed to make that contingent on the going back to school safely plan to include a mask mandate so so unless i'm wrong the pv school board the pv school district has almost 41.5 million dollars contingent on making a mask mandate which we have a school board member employed by a company filing suit to make the mask mandate legal or the anti-mass mandate putting the power back into parents hands legal yet we still keep on hearing that we're evaluating it and and i kind of get the feeling that the decision's been made um because we're already forming committees and spending

014that esser money right there's all kinds i've just got an email recently that said pretty much most of the money's been allocated one way or another it's not an endless pit we're almost done um it just doesn't make any rational sense to me unless this is just kabuki theater and we just want to make parents feel better that we're not really going to mask their kids for almost ever until until the indefinite future um also i just want to say that your data is very dirty so when you look and say well how many parents really want their kids masked the first week of school before parents learned that if two kids are mass they don't have to be quarantined 80 percent i got that from two schools i got that from a principal 80

015percent of the kids and parents families decided they did not want their kids masked 80 percent i know you're coming back with data that only so many people filed um opt-out forms i talked to one of my principals he never mentioned it other than the email that dr bail sent out parents still may not know my my son told other friends you know you don't have to wear a mask you can have an opt-out they told him he was just full of it you're joking me parents don't know and some parents are skeptical they think you're tricking them you want me to respond or not yes just real quick there there is no conflict of interest the attorney general's uh handbook i can send it to you nicole if you'd like uh the reference to

016school board members and our um sr money is not contingent upon having a mass requirement i'll have dr corson follow up with you afterwards just real quick so we know where you're referring thank you the next card i have is dr fred i'm sorry i'm not sure i'm going to pronounce this correctly alts dr fred hiles like in the british isles and um thank you for letting me speak briefly uh at the last school board meeting i was impressed with how polarized you know the group is here about the vaccines mass quarantines sex education critical race theory and lgbtq and some of the members complained about the picture of the naked male hung up in the hallway that the teachers thought was art and so we're kind of concerned that the u.s education is ranked

01727th among developed nations but has the highest cost a national survey done by ed choice last july showed that only 31 percent of public school parents were satisfied with the education their kids received stephanie brown tried to give us conservatives some helpful advice but we were so enraged that we drove her away by calling her a wolf in sheep's clothing and so i'd like to exhort our members not to make enemies that's not to call the school board devils and tyrants that just really polarizes us and so i'm really new here the last board meeting was my first time and this is my first time speaking and you know i really don't know enough to be critical or to praise anything and so i'm you know like to learn more and maybe you know find

018out what the school does you know to give us you know um members or people uh you know a chance to look at our school system to see you know what kind of education they do produce and um so we can sing you know your praises or you know if we find something haywire you know to do something about it and so i thank you for letting me speak thank you [Applause] thank you the next card i have is from trevor nelson president greenberg and members of the board i'm trevor nelson i'll keep this quick um let me start here so on the whole humans are terrible at making decisions based on new information the schools of social psychology and behavioral economics tell us that an automatic enrollment increases participation in something doesn't mean that

019there shouldn't be an opt-out but that opt-out shouldn't be unlimited or without proof some people will say well i can't make new decisions based on new information that's not how it was in my day that's a status quo bias masks work there's ample evidence out there that universal masking works in school settings universal masking which is no matter the vaccinations vaccination status is one of the critical tools that schools need to have in place in order to have in-person school in addition schools need proper ventilation to circulate the air in the classroom and hepa filtration units to capture the airborne particles that carry the virus to clean it out to decrease the viral load in the room regular testing is important to detect some symptomatic infections and asymptomatic infections and tracing to identify closed contacts

020is really important and then the isolation of infected individuals in quarantine of those close contacts those are all steps that need to be in place in order for us to have in-person school and when students are exposed they should wait the six days from the exposure go get a test and when they have a negative test they can return to school that should be no matter the vaccination or mass status it shouldn't be like oh well you were wearing a mask you don't have to stay home you should have a negative test if you were exposed in order to come back to school if any of those steps you can't skip any of them just because of vaccination that's due to the delta variant and all these layers of protection work hand in hand to

021keep students safe now i'm not super pleased with some of the decisions dr bales has made and some of the decisions this board has made the mask opt out was supposed to be limited and it's currently not it's very widespread in schools there's lots of confusion in fact there probably should not be there there actually absolutely should not be an opt out you should wear a mask if you want to be in person do you protect those around you that being said i'm not here to call for anybody's resignation or recall because that's stupid i'm here to work with you as a partner give you good information and make sure you do the right thing um so we need to make sure those things are in place in schools it should not be an optional

022thing these aren't in either or these are the layers of protection that children need to stay safe thank you the last card we have for call to the public is shad avasti and again i apologize if i got that wrong no problem good evening i'm dr shad marvasti and so i want to say good evening president greenberg governing board members superintendent bales cabinet fellow pv families online and in person i am a parent of three children a sixth grader a fourth grader and a third grader um and two of them are in the self-contained gifted program um here in the in the school district and i'm speaking tonight as a parent and also as a physician my background is an md and i also have a graduate degree in public health and i train future

023physicians in public health my concern is that we want to ensure that children stay in school and learn in a safe learning environment and is optimal for them for many reasons biologically physically psychologically mentally to stay in school in order to do so we need to create a safe environment for the children the best way to do so is to follow a layered approach in terms of all the science that we have and unite together to be able to use the science to help keep children safe as you may be familiar the cdc recently released guidelines about hepa filtration systems which were very eye-opening to quote that study that was cited by the cdc two hepa air purifiers without universal masking reduced aerosol particles which we know that cova 19 is spread through particles in

024the air by 65 percent where as they compare that to just universal masking without hepa air filters there was a reduction of aerosol particles transmission by 72 percent but when you combine the portable aerosol hepa filters in the classroom and universal masking that reduced aerosol transmission by 90 percent and so if we want to really optimize the safety environment we should employ both i believe this is an equity issue as i mentioned two of my kids are in self-contained gifted program the parents banded together and talked to the teacher and actually self-funded to have hepa filters in those rooms in those classrooms but not every classroom and every school is so fortunate to be able to economically afford to be able to buy these hepa filters we need to use coveted relief funds and districts

025monies to provide safe environment for our children enduring a global pandemic of epic proportion such as this one particularly with the delta variant which has now caused a disproportionate number of kids infected with the virus than ever before during this pandemic and also hospitalized and higher death rates as well we need to be able to use all of these measures in place so i urge the district to consider putting an agenda item together and i'm happy to offer any kind of expert support and assistance my time is yours to be able to develop a plan that we can protect our children and use all of the the means and all the tools that we have together and band together because we need to unite against the virus thank you all very much next on the

030the media center at shadow mountain high school later in the agenda the governing board will consider and approve gifts and donations i'd like to thank mrs stacy husher executive director of the pv schools education foundation and the pv schools education foundation board members for a generous donation totally more than 24 thousand dollars that will help so many of our students governing board president ann greenberg will share a few comments and words when we get to that later in the agenda as well lastly i want to provide you with an update regarding our mask regulation positive code 19 cases and student quarantines as you can see on the chart displayed above following the august 19th math regulation we saw a decline in student quarantines supporting our intent to keep students in classrooms what we do best

031is teach in person and we want to keep students in class this snapshot in time offers evidence that our community has worked together to reduce the amount of quarantines in our schools thank you all for helping in this effort we continue to collect data on positive cover 19 cases and i've displayed a snapshot in time on the next screen above following the implementation of our mass regulation we're seeing lower numbers of positive cases in our schools while we hope these numbers continue to decrease even further this information does suggest that masks have an effective have been an effective factor in reducing quarantines and positive cases as a reminder pb schools publishes our information on the cobot 19 dashboard twice a week you can find the dashboard at pbschools.net forward slash copit19 the data we have

032collected thus far presented here tonight is intriguing what it means for a cova 19 mitigation strategy going forward i can't yet say what i can tell you tonight is this our dedicated staff continue to monitor public health guidance local laws and best practices around copenhagen mitigation we remain committed to doing what we can within our authority and with the intention of working through the diverse needs of our community to help keep healthy students while in pv schools healthy and engaged in learning should the mask regulation or other copa 19 mitigation strategies change we will make sure to inform our school families through the website email and social media and those are our comments for tonight thank you very much dr bales now we move to items for approval first on our list consideration approval of

033a new mou to the certified bargaining agreement and i'll turn it over to dr holmes madam president members of the board cabinet and guests as you are aware we are continuing with pvconnect this year but as a district model as opposed to a site-based model and what we are experiencing is that we have actually been challenged to find teachers who want to teach in this model as such we are in in our pvconnect classes we are experiencing some class sizes that are above our stated maximums um which presents a challenge for us in terms of you know how do we want to remedy that so working with uh cabinet and pvea what we have before you uh is our recommendation uh to remedy that uh situation uh and i will share with you that this

034is uh modeled after what we already do for uh overages um for special education caseloads so that's uh that's how we developed it if you will i have been uh advised that uh pvea uh the executive board uh unanimously supports this mou and so with that we do recommend your approval and i'm happy to take your questions thank you mrs barryman we have a motion to approve so moved does any member of the board have any questions comments seeing none all those in favor please say aye aye aye aye any opposed motion passes unanimously thank you next on the agenda we have several items that are consideration approval revisions to various policies and i will turn it over to dr bales thank you president greenberg governing board cabinet and guests items h 2 through 20

035our second reading policies we had a excuse me policy 25 2-25 we have a second reading for these for approval we do have two items items number h3 and uh h22 that have uh comment cards but i would recommend uh since we haven't had any further questions from our first reading i would recommend that the remaining items number two number four through 1 and 23 through 25. you consider as one motion for approval tonight well i think we can actually i think what what we will do is um hear from the folks who did comment cards okay and then we can make a motion and discuss and if we want to remove any from the motion at that point i think we can sounds good that was that that's it so i'll speak to item

036h3 first then okay that has a card or two okay yeah you want me to recommend it just an overview to this policy is consideration approval of policy bedd rules of order mrs greenberg elay speaker yes we have two individuals who'd like to speak to this again please state your name when you come to the podium the first i have is denise camber good evening my name is denise camber um the only issue i have with this is item h where the governing board president may recess the meeting i just don't feel that one person should have that power i feel if there's one thing we have seen over the past year and a half or so um giving one person too much power just isn't a good thing i feel if something comes up

037and and you miss greenberg would like to end the meeting i feel that the other board members should have a say in that thank you thank you the next card we have is from wendy muller hello again regarding the bed rules of order h i am imploring the board to vote no on this revision to give the school board president alone the power to recess the meeting without a vote this revision is too vague and open to interpretation as to what deems decorum it is overreaching by giving the school board president sole power and may disenfranchise the public to sufficient the government for a redress of grievances per the first amendment which could also subject the school board to litigation thereby taking away district funds that could be used for education rather than lawsuits finding

038first amendment rights this revision is only a suggestion by the arizona school boards association they are not a governing board this is not a state statute and the paradise valley unified school district does not have to implement this change to the rules the rules that are already on the books you already have in place line item d which states a motion to adjourn is an order at any time such a motion shall require a majority vote no discussion is in order also if the decorum is so devolved we have assigned police officers here on property to keep the peace in addition i believe the congress of the united states does not have such sole power either please vote this revision down as there are already rules in place to adjourn any meeting at any time

039and already as the public already feels disenfranchised by given the small amount of time to convey grievances and concerns to this board no one person should be given such power on such fake terms thank you president greenberg governing board cabinet and guest just to clarify this policy makes the change clear the governing board would have the story to recess recess is a temporary pause in the meeting for less than 24 hours is not an adjournment to the meeting so just for clarification excuse me the next card or the next agenda item next card is kb do you want to discuss what that one is before this consideration approval revisions to policy kb parental involvement in education for a second reading [Music] this policy language which requires parents to up their children out of any curriculum

040learning or material or presentation it also reiterates language in ars 1513113 requiring parental consent to provide before providing sex education instruction to the student this is consistent with our practice in the district for requiring opt in for any sex education materials and instruction this matches our current policy for parental opt-in thank you so the card we have is from trevor nelson thank you president ruber i just have a quick comment um there's a redundancy in here uh you guys there was an addition of sorry to say you guys but there was an edition of jay which is almost identical to h which is the old g it simply says procedures parents notified about opportunity to withdraw their kid the new one and jay says opt their children into um it's a very subtle distance it

041also adds the word learning materials i'm not sure why there needs to be both considering they also are kind of contradictory things opting in is different than withdrawing um also the new g i get it that it's consistent with some of the new laws but it's already mentioned in d which is shall have access and advanced instructional materials so we're just being redundant also i think there needs to be a note that it needs to go in line with ars 15 730 which outlines um those parental rates and also those curriculums for sex education so that's that's just all i decide that was interesting that the new uh the new j is redundant of h and also switches so there's just redundant language and then switches from a withdrawal to an opt in so either

042way opt-out's better because then you get more participation but um either way just want to bring that to your attention thanks thank you um i do not have any other cards so at this time mrs brown had asked for a motion to approve and then the board can discuss so moved does any member of the board wish to discuss any of the individual policies or comment certainly um we we did discuss all of these in the first reading so and we have um had the chance to review these and go through them and um a lot of the changes were to align better with the state statutes because the state statutes changed subtly throughout time and so this allows our policy and procedures to remain in line with the new state statutes um and so

043we did have ample opportunity as a board to review each one and have discussions about all of these items so we have heard all these um issues prior to tonight thank you ms mature does anybody else have any other comments seeing none all those in favor of approving all of um our new board policies etc please say aye aye any opposed motion passage unanimously thank you next on the agendas consideration approval of gmp number two for contract mrs barrigan thank you president greenberg and members of the governing board if you'll remember back in june we actually had you all approved the gmp number one for this and we split that up into two pieces so that we could get the work uh to begin on palomino primary without having a delay for the start of

044school for next school year so that was approved as a seymour for palomino primary school renovation demolition in the amount of two million five hundred thirty nine thousand one hundred thirty two dollars this portion of the project consisted of the demolition of the multi-purpose building and building a additionally this included the pre-purchase of select materials for the masonry and still steel with earthwork packages or with early work packages of earthwork and site utilities and gmp 2 is to complete the palomino primary school renovation project in the amount of 12 million 368 255 dollars this is the second piece of the gmp which includes the following a partial campus demolition with replacement of 55 400 square foot of new building new playgrounds hardscape and landscape additionally there will be a new 43 200 square foot two

045story classroom building along with forty thousand square foot of site work that includes new shaded playgrounds an open play field and fifty parking stalls there will also be renovations done to the interior administration office and the multi-purpose building gmp-2 remains within the budget amount of 16 million dollars that was originally allocated for this project and the projected date of completion for this project is july of 2022 to be ready in time for school in august of 2022 and i'm happy to answer any questions you may have thank you ms merrigan mrs brown and we have a motion to approve and then see if anyone's questions so moved i know mr matura had noticed uh thank you can you remind me why this project was targeted as being the current need for the district uh yes

046though i was not here at that time my understanding as well as what i witnessed myself when touring the site is that it was sort of a piecemeal site that was constructed and constructed in various eras over different times and not necessarily put together in a very cohesive manner or a manner that made it easy for the monitoring of students additionally there was not sufficient play space so this should offer some more play space for those students and of the modular academic buildings that we have from that time period and we do have a number of schools that were built in the same fashion this was the one that was in most need of being replaced but we will likely see others that were built in that same style to be coming up for replacement

047in the future thank you um also i just wanted to confirm for a guaranteed maximum price that locks us into that will be the maximum that this project cost so if there's any delays which runs into cost increases or materials that they're having a hard time finding we won't be on the hook for that that is something that we are guaranteed to be coming under this price yes that's correct the only way the price would increase is if we were to initiate a change to the project which we do not intend to do okay and in other projects um that we've done the the gmt the guaranteed maximum um price have we seen savings has it ever come back to us where it's coming under budget yes um fairly frequently we do see that actually

048um some of the larger projects most recently were with campobello which i believe started a remodel or rebuild in 2019 and i think completed in 2020 and we saw a little over 69 000 come back from that project and then with sky crossing our newest elementary school we had about 600 000 returned from that project so those are two recent examples great thank you very much thank you thank you disney mrs case thank you um i don't know if you have this answer right off the bat but maybe generally when was this campus built and i know you said it was built in stages so i'm just curious how old it is i have a plaque kindly provided to me by the facilities department in my office that lists all of the dates of our
