Board of Education. Okay, we're going to call the Tuesday, April 21st, 2020 session Board of Education meeting to order. Please stand for the pledge, please. I pledge allegiance to the flag of the United States of America, and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. Okay, first item of business is the acceptance of the agenda. Can I get a motion, please? I Second. Mike. Any discussion on the agenda? Just a typo under non-instructional. Uh for Joe Waters, it should be 4 18 2027. I apologize for the wrong date on there. 4 18 Um 4 18 It's a Oh, I see what you're saying. Sorry. 2027. 2027. Uh 2027. Mr. Payne. All those in favor? I. Any uh any opposed? The agenda is accepted. Resolution 075-2025

approving the items on the consent agenda. Motion, please. Mike. Joe. Any discussion on the consent agenda? All those in favor? I. So, the agenda is approved. We have to approve it as amended. Yes. As amended. As amended. Yes, I. Thank you. Uh next is public comment. Anyone like to address Board of Education tonight? Let me read this first. I'm obligated to do it. Board of Education encourages public participation at school-related matters at board meetings. The board is here to listen during this period of the meeting. Persons wishing to address the board should state their name and their organization. Three minutes will generally be granted to each speaker. Speakers should conduct themselves in a civil manner. The board can cannot permit a public session discussion about individual district personnel or students. So, please don't use names

of staff or students. Persons wishing to discuss matters involving district personnel should present their comments and or concerns to the board through a written statement. Public session is generally not an interactive question and answer period. The board would like to have addressed specific questions or responded to specific concerns from the public at this meeting. Persons with specific questions should address those questions to Diane Fox of Greater Albany Schools. The president shall have the right to discontinue any public comments that violates this policy. Go ahead. My name is Christopher Colwell. I'm a parent. I guess I can't mention my daughter's name. I'm here tonight requesting that the Board of Education issue a formal letter of support for our daughter and demand that FEH BOCES, the Adirondack Adirondack Educational Center, reverse its decision to uh to deny

her induction into the National Technical Honor Society. This denial represents a systematic failure of procedural due process. She is being penalized based on an informal attendance policy that was never properly communicated, was supported by factually incorrect data, and offered no warning or transparent appeals process to the student or or us. Uh the admission of an informal policy and plain sight violation. The superintendent of BOCES attended a meeting with my wife and Superintendent Diane Fox and admitted that the attendance threshold was used to used to disqualify Lauren as an informal policy. The bulletin board fallacy, superintendent Bolt, asserted that this policy was compliant because it was posted on a bulletin board. Under New York State Education Law, plain sight notice requires that policies be effectively communicated via official handbooks and orientations. A notice on the wall,

especially during the September through November 2024 administrative vacuum when there was no principal present at the AEC BOCES at the Adult Education Center does not constitute a legal notice. Uh this is a potential violation of the Americans with Disabilities Act. Uh medical necessity. Documented medical necessary treatments were recorded as unexcused absences and used as a primary basis for her disqualification. Discriminatory impact. Under the ADA and Section 504 of the Rehabilitation Act, students cannot be penalized or excluded from honors program and educational opportunities due to the absences resulting from documented medical conditions or necessary treatments. By using these absences to block her induction, the AEC is in potential violation of federal civil rights protections. Number three. There is a total failure of parental and student notification. No warning. Even under the informal standard, basic educational fairness

requires that a student be notified if they are approaching a disqualification threshold. Uh she and we did not we received zero communication or even regarding her attendance status prior to the denial by FEH BOCES even when the attendance review was completed by FEH BOCES at the Saranac Lake Central School. Deprivation of remedy. This lack of notice deprived our daughter of the opportunity to correct clerical errors or provide documentation for excused absences before the induction list was finalized. Factually and legally flawed attendance data. The AEC calculation is based on false data and cool incorrectly penalizing our daughter for institutional closures. She was marked absent for one district-wide snow day, one super superintendent conference day, and the day that the district was closed due due to a power outage. These days were incorrectly counted against her. Educational

access. Central college visits for her enrollment at the University of New Hampshire were counted against her ignoring their status as excused educational opportunities. Failure to to convey an explicit appeals process. Administrative instruct instructions. The AEC failed to provide any formal any written formal procedure for appealing the NTH denial. It is a breach of an administrative duty to force a student to navigate a hidden appeals process while relying on bulletin board evidence that was never part of the formal orientation. We ask the Saranac Lake Central School Board to take the following actions tonight. Issue a formal letter of support on behalf of our daughter based on FEH BOCES significant significant administrative errors which may continue to exist today, encourage FEH BOCES ABC to immediately reverse the NTHS denial. To write reject informal governance. Uh The high

school here this year did an initial application for uh to our daughter via the the high school guidance office without providing the NTHS requirements. Both the high school and FEH BOCES need to understand the policies and procedures of the programs and provide all the necessary information to the students ahead of time and not retroactively. Address the federal compliance issue. Recognize that penalizing a student for medically necessary treatments, procedures is a substantial violation of the American Disabilities Act and must be corrected immediately. In closing, leadership and transit transparency are not optional in our school system or the programs at the Saranac Lake Central School District. Support and allow the students to attend FEH BOCES. Failed to provide a principal for 3 months using informal rules and maintaining inaccurate records in a potential violation of federal law

and this issue has been noted to the New York State Department of Education Commission. Saranac Lake Central School District and FEH BOCES uh ABC have failed our daughter administer administratively administratively, which has led to the loss of admission into the National Technical Honor Society, scholarship access to the NTHS and the ability to be part of the NTHS programs at her college at the college university in Hampshire. She has earned the honor of being part of the National Technical Honor Society for years of academic excellence and hands-on work at FEH BOCES, but administrative errors and oversights have created an environment where the inaccurate information was considered. We ask the Saranac Lake School Board to stand with her and ensure that administrative negligence does not define her high school career. Thank you, Chris. Um we're not going

to have a lot of back and forth on this, but I do have a couple of points that I think I I can help you with. Um You understand we don't have any per se overrule BOCES, correct? I understand that, but I was hoping that a letter from you would help I thought that was the the very least that you could do in order to uh support our position. >> So, I don't have any real um depth of knowledge on what the rules are for for this award. Um It is what it is. Because it's not ours. Yeah. >> Um and and I do not uh have a depth of understanding of all BOCES policies. So, I can't speak for that. I understand that. Um the best I can give you is is an analogy

from my world when I was athletic director. Um if we had a student of ours um ejected from a contest um and we felt that that ejection was unwarranted or done improperly as a district we have no say in that. Um athletic council handles that. Um if we had a coach ejected we could not override that. All right. So, I've seen those things happen. I've seen them happen justifiably. I've seen them, in my opinion, unjustifiably. I'm frustrated um because we voluntarily enter into that. And so, we agree to abide by their rules. Um similar situation with some of our merged teams where sometimes I have situations where different schools' training rules are slightly different. And we've run into that before. Um We would not have the ability to tell another school that they must abide

by our specific set of rules um and vice versa with that. So, those are frustrating instances for us. Um Can I interrupt you? Let me finish, sure. I don't think that uh um tonight I would be willing to um um act on any of these because I don't have enough information to know um what what has happened on the BOCES end. Uh I have what you said. By the way, I really appreciate you sending the letter, Ed. It's helpful to be able to have that and have it in front of us. I wish everybody would do that. And I totally respect you coming here um to to stand up for your for your child. Um when I was at District, I would tell parents all the time if you're not standing up for your kid,

who is, right? So, I respect that. I just don't know that I have enough information from the other side on this. And I don't know that I can obtain that. Um I I don't know if there's a deadline. I don't know if they have a appeals process. I don't know any of those things. So, I'll tell you what I can do. I will be seeing Mr. Breault tomorrow. I can make an inquiry uh to see if I can get more information. We would appreciate that. That's That's what I can tell you I can do. He's likely to tell me similar things that he's told you, I don't know. But, I will be seeing him. I'll ask him about it. Um and and if there is a uh a mechanism by which we can be involved

uh and there And the deadline is whatever it is. You know, that could be a future consideration. But, I make you no promises on that. I understand it. So, I have a question. How much money does the school district provide to BOCES? It's irrelevant because they're paying for a service. That payment is not oblige us to have input into their policies and procedures. Just like they don't have input into our policies and procedures." Right. But the high school here is considered the home district. That's correct. Right. So, the attendance here is different than the attendance over there. Still not our purview. I understand. So, this is where um one of the issues This is the main issue of why why this has come to a head. is the way they do things, the administrative vacuum

that they have, their principal started 3 months after their first day of school at the beginning of her term at BOCES. All right, I get that. But They're in They're in violation of the law. And I'm not I'm not saying I'm not saying that you can do anything about it. But that's that's my interpretation. I totally understand your frustration. I I can sense it. And and and and it's clear. Um I can't speak I know that you can't >> I don't have the other piece. I understand. And I'm I'm willing to make an inquiry uh with Mr. Brio when I see him tomorrow. I will do that. Um if something seems like there's a um I mean, I don't know. I don't know what the policies are. And and nor am I willing to tell

them, you know, that they should change their policy because they don't tell us to. We would not want him to come in and say to us, "Hey, what about the You know, I I'd like to see if there's anything there. If there is, um we'll see. If there isn't, I will correspond with you, let you know that there's nothing to be done or there might be. I'd like that you're admitting you're admitting that you don't know what their policy is. Cuz we don't know what their policy is. Yeah, I can't fix that. You can't fix it. But you can see the frustration that we even have. And so, this doesn't just affect one student. This affects all students. But But, I I hear I hear what you I hear what you're saying, but this is

this is a systemic issue that But, it's it's it's not our issue to fix. I know, but it's my it's my responsibility to uh to responsibility to bring it to your attention. >> I I agree. And And if there was some Isn't there a BOCES representative for this school? I think it's Rick Petrocci. Correct. And isn't he Wouldn't he be like the middle man to discuss situations like this? Your your your remedy is with the superintendent of schools and BOCES. Yeah, but I was trying to find a bridge between the two districts, and I think that's this man. Well, Rick Rick sits sits on our committee. I don't know what the committee's purview is if there's a policy. Again, I don't know I've never actually looked at a BOCES policy book, so I don't know.

Neither do I. I know ours is plenty thick enough, so I'm Right. But I told you that I will make an inquiry, and I'll let you know um you know, if there's if there's any way we can do that. I think we're all in agreement that uh um you know, you should support uh your child in this, and that uh um from your perspective, you think there's an injustice done. I absolutely do. >> I don't know that to be true, cuz I just don't know what it is I'm talking about. So, what you're saying >> Can I tell you a quick story? It won't be too short, so you know. Sure. Um when I was in my dean of students' office, this got to be 15 years ago. My daughter was up for uh um

National Honor Society, and there's a minimum GPA for about And the guidance counselor at that point uh came in and and said that document and I said, "Yeah." And proceeded to tell me that she missed it by so many hundreds of percent. Very narrow. And was expecting a pretty built-in fight out of me cuz that's normally what happens. And I said, "Well, the line is the line. If she missed the line, she missed the line by a little or a lot. I feel bad for her, but I'm not going to sit here and let her challenge it. Now, that's my personal view as a parent at that time. Probably because I deal with where's the line all the time in my professional career. And that was constantly a question asked me. Well, it's only this

much. It's this. And you know, I dealt with a lot of tennis issues that relate to a lot of other things in our district. So, I have some personal experience with this and and and the heartbreak that my daughter went through on this. And certainly her frustration that somehow her dad couldn't wave a wand and fix this. I understand that. But you bring up the point that you know where the line is. We didn't know where the line is. I I I sympathize with that. So, I'm going to I'll make an inquiry and one way or another I'll get back to you on that. Does your letter have contact info? Uh do you have the Gmail? Okay. So, make sure I get that from you before I leave. All right. I can do that for

you and I can't promise you anything. >> Any help that we can get from the high school here? Did you ask if there's an appeal process? Yes, he didn't know. Okay. So, they're they're they're the people. I'll make an inquiry. I have good faith that we're going to try to see if there's what's happening cuz I'm I'm I'm not up to speed on that part of the situation. I understand. And then there's an additional remedy which is you mentioned in your in your note here Commissioner of Education. Uh we have informed them of what's going on and they have a 30-day window of when the denial was uh presented. And then so we didn't know if that denial also included uh the move up such line here tonight is so that we're in that 30-day

window. >> So we don't know if that's always an option. Always possible and that's >> That's a That's a route that we are strongly considering. But it's uh Just because we don't we don't know the appeal process and we have asked. And so that's when we had to reach out reach out to them to see if we can come cuz technically they're supposed to have a an attendance policy. And we don't have that. It's correct. So Mark let us know Yeah, I'll I'll let everybody know. And uh And nobody likes to see their kids with their masks on I'm pretty sure but uh I appreciate you coming to speak on behalf of the children. Thank you. Thank you. Okay, moving on to uh financial reports. Looking Okay, so um All right. Since the meeting is

just last week, there's not that many of our budgetary transfers. They are on the drive like always. There's two that are over $10,000 this time. One is to purchase Chromebooks for the elementary school. And the other one is um to cover the desks for our new Yeah, and I would I would note that probably this is as the best time possible to do some of this stuff. Uh upgrades and some of the stuff. So how long have those desks been here for? Since A and A started we do some of this stuff. And that's 30 years. So if you're going to do it it would be nice to uh if we can in the right places we can and we'll be able to move around. Present them with some new uh some furniture to uh

work from. Anything else? Um the rest were mostly related to substitutes. Okay. So, resolution 076-235 approving the current budgetary transfer form was presented by the school business executive. Joe. Second? Mike. Any further discussion? All those in favor? Aye. Any opposed? Resolution approved. Thank you. Um this next resolution, it was added to the time I wrote but with the addition of meeting and substitute dean of students that was approved in the consent agenda, we have to add and approve rate for dean of students. So, that's the line highlighted in yellow on the extra pay and substitute rate schedule. A long-term teacher is already 5% and we went off of that to get to the dean of students rate. Dean of students specifically has a 5% adjustment. The salary is allowed counselor but actually more. Yes, it's

slightly over 5% mainly because of the extra responsibilities for that position. So, resolution 077-235 approving the extra pay schedule which was updated on 4/21/26. Um motion, please. Mike. Second? Zack. Any discussion on this on the schedule? All those in favor? Aye. Any opposed? Schedule is approved. Okay. No problem. Moving on to old business, uh seeing the rest of our groundwork here at the high school on the week of May 1st. They'll be on site to walk it next week. And then they'll actually began some work that needed to be out of the frost time. So, depending on what the weather looks like, the earliest could be the first week of May and then they have to push back. And based on the weather report, it could be August by the time we're done. But, besides

that, we are wrapping up and and those are really wrap up projects, too, which is why they're all timed in the fall. So, they're all kind of ready to go. We just need out of non-frost time in the fall, so we'll be pouring in the spring. Besides that, getting there. Okay, resolutions 078 2025 approving the use of up to $100,000 of funds available in repair reserve. We're creating a business office district office space control. Motion to this? Mike, second. Joe. So, for discussion, we long talked about talked about this long and developed that um in in in our move there would be some sort of the um money needed to be allotted to uh move some spaces around and and and they get uh Diane to pick a good spot to uh rehab our relocate

our our business in September operation. Um spoke about it last meeting, so ready for the questions on that. All in favor? I. Any opposed? Resolution is approved. Resolution number 079 2025 approving a contract by between the Saranac Lake Central School District and next year a contract in the amount of $34,750 for wall patching, priming, painting, and the addition of drop ceilings. Motion? So moved. Second? Joe. Joe and I. Any discussion on that? I think uh and first on that last meeting. Questions? >> So, is that over and above the um No, that would be part of the That's part of that. Yeah, so those two pieces, there are some um hardware that we have about $10,000 worth of hardware that we purchased and the the least expensive way to buy it is for us to

buy it cuz then there's no overhead and profit and all that stuff on it. So, it will cover those two that and then it left us a little room perhaps for the beginning of some carpeting or at least some clean-up work on the floors in those rooms. Anything else? Okay, all those in favor? Aye. Any opposed? Resolution is approved. Resolution number 080-2025 approving a contract by between the Seneca Falls Central School District and Next Era Contracting in the amount of $32,500 for required electrical upgrades. Motion. Move. Second. Yeah. Discussion. I talked about those previously. Modern offices are power-hungry and most of those rooms are not set up for adequate power, so we need to get that in there. All those in favor? Aye. Aye. Any opposed? Motion carries. New business. Uh resolution 081-2025 resolution for

the approval of the FEH BOCES administrative budget. Um be it resolved that the Seneca Falls Central School District Board of Education and this will be based on a vote for the uh for the education services budget amount of $39,954,420. So, let's get a motion. Uh Take it up. Motion on that? Motion. Second. Yeah. Any discussion on the budget? Any opposed? What What would What would happen if we did not approve this? Go ahead, Dan. We We've done that regularly in the past. Um and it it's a majority vote, so all component districts are So, if we don't We would be You'd be one of the many It has certainly. Yes, it was a badge of honor for many years. It's like a protest vote sometimes. Cuz the formula works ideal for some districts. It doesn't

always work ideally. So, but it would be the same as us if it would go to the contingency budget anyway, right? >> If everyone voted it down then Everyone voted it down, right? Yeah. That's That's good. Yeah, it happens. Okay, um I was thinking I was better. I I made a motion. Resolution number 082-2025 resolution for board membership um I'll turn it over to Gina. Let me just get out of the motion. Second. Second. All right. Okay. I'll turn it over to Gina to go through the motions. Um so, do you want me to read through Yeah, and then yeah, and then we'll do the names. So, be it resolved that Saranac Lake Central School District Board of Education cast one ballot for each of the following candidates for membership. And Franklin Essex Hamilton BOCES

Board of Cooperative Educational Services and hopefully there's a check mark beside each of the names of the nominations for candidates at the bottom. So, it'll be a result saying the name and then you vote yes or no. And then when I read the vote I'll read the vote to make sure it's what you mean. Vote you want It'll be an affirmative vote. If you're in favor, you say aye. Aye. And then if there's opposition, then no. And check. All right. Jill and Joyce. Aye. Aye. Nicholas and Sue McNally. Aye. >> Aye. Mary Ellen Cook Hi. >> Aye. Corey Green Hi. Dwayne Williams Hi. Hi. All positions are approved. Resolution 022025. Okay. Move forward to our first please. Yes, I got all the people working. And item C is also Eugene. Yes. So we have three

people submit their um paperwork for running for school board. Um there is Mr. Joe Henderson, Mike Martin, and um Scott Gibson submitted their paperwork. So, I have their three names on these little pink pieces of paper and this is to determine how they are placed on the ballot. Um all three of the candidates are going to be running for two board seats and they'll run at large. Both of the um seats are three-year terms. So if you got to one of them are different, so either one is correct. All right, so Ron, would you like to pick the first name? Let's put Elliot in. Elliot, would you like to pick the first name? Um sure. Come on, Elliot. All right, so the first candidate's going to be listed on listed on the ballot. Scott Gibson

Scott Gibson will be first on the ballot. Will you pick the next one? Joe Henderson And I'm I'm guessing that Mike will be last. Being that there's three. Mike is third. Oh, that's right. I'm sorry. It will be confirmed Mike Martin. Yes. All right, there we go. Thank you, sir. Very much, even though there's sparkles on it. Good luck with all the candidates. Next item is a possible cancellation of the meeting currently scheduled April 29th. I think we can Last night given the volume of that >> I think it would be a very good idea to meet last night. What is What is the date of the next board meeting after that? Okay, so that would be 3 weeks from now. So, no, because next week would be the 28th. And then the 6th, so

Oh, yeah, we're pretty stacked up. We are stacked up. We moved some things. I heard someone mention there's a lot more on here than we had first talked about. Uh we did that so that should you decide not to have a meeting on the 28th, we didn't have anything of pressing business that we needed to announce. You have one on the 9th Friday, right? Right. What? It's the budget money. Yeah, right. So, we have to meet to go over that. Would anyone like to make a motion to cancel the April 29th So moved. Anyone like to second that? Any further discussion? All those in favor? Aye. Any opposed? April 29th is canceled. Okay, moving on to reports. First up is the superintendent report. Uh May 27th, Mark the calendars. I've not heard from Mark and

one other person. I can't remember who it was, but Oh, and Mike. Uh top, but I'm hoping you're all well. Everyone else is available for May 27th for a board retreat. We're working on where that retreat is. That's a Wednesday, right? It's a Wednesday. Yes, the charter picked Wednesdays. I'm good to go. So, I apologize for not being No, it's not a problem. Just I I wanted Our calendars are just a little full, and I but I do think the topics we would include the information from the Northville superintendent and Zach's trip, and it is a great time to work in the resolutions also. They all just seem to tie together, and that would be a great working meeting. It would be open It would be an open meeting. People would come and watch us

eat and do our work. Uh but we wouldn't vote on anything at that meeting. We would simply make some plans and then bring it back to the next meeting. Well, they're sharing the food with the No, they have to watch us eat. But uh and we're not sure what we're eating. Uh it may be chimichangas. Is that what it was? Chimichangas is a little joke between the two of us, but uh that'll be good. And I would like to uh request a five-minute break, but I would like to request a an executive session um for the discussion of a student. So, if there was some information I can provide from uh public comment this evening, but we need to provide student specific student information that we need to say in executive session. Do you want

to add that to Should we vote to add that to the agenda at this point? Well, I don't think it has to be added to the agenda. I think it's uh you know, we'll have to adjourn to the Yeah, right. So, we got to have a little motion to go into Yeah, right. >> Yes. Cuz I can Yeah. An executive session can be called at any time. Yeah, right. >> Or it's on the agenda. Right. Right. Yeah, right. Anything else, Anne? That's it. Um Let's see what we have here today. Melissa again, of course. Um just quickly, we're in Well, we're halfway through cycle four on our um Freshmen of the Mountain. Um this cycle, we're looking at next three classrooms in our own learning spaces through a DEI lens, and the implication of equity

depending on which classrooms our students walk into. And then um you know, committing to concrete shifts in our own spaces to uphold um district wide accountability. That's it. Okay, thank you. Erica? We were uh awarded a 2026 Empire State Summer Service Corps member to join us starting May 15th through August 31st. They um this young person is an alumna of the Saranac Lake High School. He's now at Stony Brook University and I'm so thrilled that uh he applied and was a successful candidate and will be joining the middle school team for the summer. So, I look forward to all of you meeting him in your travels. Thank you. When they're ready for school and volunteering on what day? Oh, Thursday, August 27th from 4:00 to 7:00 p.m. at the Petrova gym. Thank you. Andy? Uh

last Friday we celebrated Earth Day at Bloomingdale with a presentation by the Franklin County Soil and Water Conservation. It was a really great presentation for the kids. We planted a few trees on the grounds and then it snowed, of course. So, we're hopeful that they survive, but um all of the children were able to take home a tree to plant and they did such a nice job with the free program. So, we thank them. Um tomorrow starts our annual walk to school program. So, on Wednesday students meet staff at the Bloomingdale Fire Department. It's part of the 21st Century programming and we walk together to school and it just sort of highlights, you know, physical activity and how that feels before school. Um Petrova's also doing it and they're including bikes um with our littles

who are like, "Let's just walk on our legs." But, so we're really excited about that. Thursdays are family tours for incoming Bloomingdale families into Petrova and we're up to 80 people who have signed up for tours. So, I think everyone's just excited to see the building and see where their new their new homes are going to be. On May 8th, you're welcome to come. We're having a pre-K grade two alphabet fashion show. So, that each kid gets to pick a letter or a digraph, two letters together that make one sound, and they get to dress up as that, and it's always a very popular um program. And then, just a reminder, June 2nd is our community open house from 5:00 to 6:30. Mr. Steve, our head custodian, found a ton of old yearbooks and pictures.

So, it's fun cuz this is Fox, we're going to have to display those and have some snacks, and so it should be a nice evening. That's good. Thank you. You're welcome. Student report. Um I just have one thing, which is that we have athletics photos tomorrow, which I know is a big thing a lot of people appreciate. Um All right. That's all I really have. That's good. All right. Now, uh committee reports. John? Do you want to talk about negotiations or is that Yeah. We can mention that we came to some a tentative understanding, but have not received anything yet in writing.
