009two and a half weeks on the job I just want to thank everyone for the warm welcome the guidance and the support I've received so far we are preparing for the new school year our principals and administrators return this week and cofd managers will all be meeting tomorrow and Friday to plan and collaborate for the year ahead this year I look forward to getting to know all of our schools and what makes each one of them special I look forward to building relationships with our team our families our students and our community members and continuing to build upon the cusd successes specific to tonight's agenda I want to point you to agenda item 11b 14 which is the Raptor visitor management system this system incorporates state-of-the-art identification verification process by scanning visitors driver's licenses or

010state issued identification cards through this Innovative approach the system performs background checks providing a higher level of security for each of our schools this concludes my comments for the evening thanks foreign happy summer happy July glad to be here and I love the work that still happened in cusd all summer long and happy birthday America it's July trustee Pritchard thank you thank you uh thank you and again welcome Dr Brown um to this wonderful July meeting um just want to take a minute as board members we don't always get the chance to be part of a rather significant opportunity for students we have wonderful ideas we have suggestions but it takes that talented individual or team to bring something to fruition on tonight's agenda we finally have that opportunity to launch JROTC at San Clemente

011High School it's kind of unbelievable and I say finally because revisiting my emails and remembered discussions this process has been almost over eight years and most definitely would not ever have happened without the commitment and Leadership from Principal Chris Carter and dedicated educator and ex-navy pilot Patrick O'Rourke and I'm just going to give you a fun facts about JROTC I'm pretty excited about this on our students are too it's not really in the agenda um but the army JROTC mission is to motivate young people to be better citizens and a fun fact is uh the rotc's JROTC started um at the beginning of the first World War the army JROTC program emphasizes character education student achievement Wellness leadership and diversity JROTC Fosters commitment dedication and awareness of the importance of citizenship and teamwork so joining

012this program in high school can provide students with structured self-discipline and a sense of community it can enhance positive feelings for among teenagers such as identity self-esteem mental and emotional well-being acceptance leadership academics life skills mentorships value competence and resilience you don't necessarily have to join the military After High School but participation does provide available opportunities and benefits in becoming a future member of ROTC they also have scholarships and many many opportunities in colleges applicants look very favorably to this so a huge thank you again to principal Chris Carter Patrick or work for May making this happen and I am extremely extremely grateful thank you great we'll go back to trustee Jones you meeting it to go there were some very very inappropriate comments made and it happens from time to time but it really

013bothered me this time and those were transphobic comments I'm not talking about people who object to their being sexual content and books whether I agree or not those are opinions that are just people's opinions but to be actually expressing hate speech in this board room is repugnant to me I found out after the meeting that two of the young women two of our students who were in the audience that night were brought to Tears by that comment those comments we are not here to tear down children whether we believe in aspects of their lives or not we're here to build up children and I am never going to buy my lack of speech indicate that I agree with hate speech with transphobia or with homophobia it is not appropriate and it is it tears down

014some of our students a student should never be brought to Tears by something that is said in this Fortune thank you thank you um I will uh in looking at ways of building up children I think there's smart work over there and I like to call on uh our own Cuca Gracia perhaps to come up and describe a little bit about the artwork that's being uh presented over there thank you very much trustee uh so we have a part of our culture proficiency plan is that we have a yearly contest for welcoming students back inclusion all that aspect that we have are our contest winners we had our staff here at the district office review the the posters the contest and uh these are the three winners um I don't have a paper with me

015do you mind if I walk over read the names that way I use my teacher voice from the cencia Middle School 8th grader Bennett rosecraft okay so these will be displayed here in the boardroom and we have copies of these replicas that have been sent to all our schools and the principals have that to display on their campus and uh we also have the certificates that have been sent for the families for recognition we've had this go to the communication Department we've put that on our social media so we're very proud of that it will be a yearly uh event that's part of our culture proficiency work thank you very much any questions and can we get that in The cusd Insider or something yes sir Chris as well yeah absolutely thank you any other

017on campus to participate in athletic activities football flag football cross country tennis baseball water polo cheer dance and a 40-plus team summer soccer league tournament has taken place multiple days per week yet despite this large demographic of student athletes Kappa Valley has not had an athletic trainer in eight months originally I plan to speak with you to bring this to your attention however I had a great conversation today with our principal Mr mccusten and he reassured me that the issue was known and is actively being resolved at the school and District level I was relieved to hear this this is being addressed but still wanted to come to speak today to reiterate that the issue is very important to the student body at Capo and their families every day and every practice that occurs without

018a trainer present students physical health at risk I appreciate how unsurmountable a task it is to balance the financials and needs of all the schools across the district but I feel that since it directly affects student health and safety getting a trainer hired to be a priority for the district thank you thank you our next speaker is Rudy Rudy Krauss following Rudy we have Becky Butler after Becky Kathy Palmer following Kathy Greg young and Brianna Boyle please go ahead and line up if you've heard your name called and Rudy go ahead okay um one minute's not enough but I'll condense everything I was at Temecula yesterday there was about 200 parents they're outraged because of the homosexual agenda the trans agenda the gender bender agenda you guys got all the students trapped in the gay

020want to speak today about the incredible English teachers that my kids have about Capo my daughter would never have a greeter but her teachers nurtured her desire to think critically about the material that was part of the curriculum what did she like the books or not she would often come home and we would talk about the books and her thoughts about them to this day she talks about her American culture class in 11th grade in this class students read classics classics like The Great Gatsby and examined the books as they relate to American history is still one of her favorite classes she ever had her teachers encouraged her throughout her Learning Journey and I'm thankful for that please encourage the teacher to continue this thank you happy that I learned is our next speaker following

021Kathy Palmer Greg Young following Greg young will be Brianna Boyle after Brianna Lynn Hayes go ahead Kathy hi my name is Kathy Palmer I'm also a long time resident of Mission Viejo my children all went to Mission Viejo schools graduated and went on to earn undergraduate and graduate degrees from UC Irvine University of Arizona and Cal State Fullerton and I just wanted to come and let everyone know how grateful I am for the education and life skills they learned in our public schools and they are grateful too so I am a retired librarian where I was fortunate to spend 27 years at UC Irvine libraries teaching information literacy and critical thinking and and as a former academic librarian I'm here today to thank some of I think the unsung heroes of public education the school

022librarians and Media School directors who work so hard to make sure that every school has the books and materials they need that reflect the diversity of experience of all students so thank you to the Librarians thank you thank you our next speaker is Greg young following Greg young Brianna Boyle Rawling Brianna Lynn Hayes welcome superintendent Brown my name is Greg young I'm a physics teacher at San Clemente High School and also the CUA vice president and negotiating person for them and I want to share with you three great things about our district collaboration inclusivity and transparency collaboration because our district has a commitment with all stakeholders which extends the collaborations between parents Educators and admin to that collaboration of CUA members with our district admin and also inclusivity because having been a high school teacher

023for 30 years now I know that the key to education is showing students how much you care before showing you how much they know and that's that's been an area of growth in all of Education that's not that's not just here for example when I first started teaching the term tolerance was used often to describe what has now become used as the word inclusive and I think that change in nomenclature is a critical Improvement we Educators meet students where they are we don't simply tolerate differences we need to be inclusive and respective of it and transparency my dealings with the cusd negotiation team has been in my opinion collaborative and transparent classrooms are transparent everything's up on canvas people can see that we're following the state guidelines the state curriculums the funny thing is if

024you'd given me two minutes I could have gotten to the better Point stay till the end welcome Brianna Boyle hi I'm Brianne Boyle I am a longtime resident of Rancho Santa Margarita I am also a College advisor in this area and work with students in this District I just wanted to talk about teachers in fourth grade Mrs Jones introduced us to Cole Porter and took us to a theater to watch shows performed live we were like grown-ups out on the town never mind the shows were at 2PM and our parents drove us there Mrs Jones also shared with us stories of Beatrix Potter a world where their lives of small animals were important and worthy I was smitten we read The Velveteen Rabbit and I felt such sadness when the rabbit was forgotten by his

025child Mrs Jones had us write our own creative stories and this might be where my love of creative writing lies and I majored in creative writing in college and perhaps that seed was planted by this teacher in high school I had many amazing teachers many that sparked an interest in chemistry a teacher who took us to the Museum of Tolerance and many houses of worship so we could learn about the history and development of religion all around the world my eyes open to the experiences of others this is why we need to leave it to our teachers to teach our students and not to others who would limit it thank you Haynes hello my name is Lynn Hayes a longtime resident of Mission Viejo and a 31-year educator our teachers need to feel free to

027an Extended Learning teacher and when no one else really wanted to I was there for the kids and I did it and I loved my job I've been at Oak Grove Elementary now for two years and just found out over the summer by my principal not by human resources that I no longer have a job as a pair of one but a para one PE teacher so now I'm going to be outside in the nice hot weather and nice cold weather for six hours standing on my feet something completely different for what I got hired for and I just want to read real fast one letter from student Dear Miss Christner you are the best assistant teacher of fourth grade could ever have you put a smile on my face every single day you put

028time and effort into helping every single kid in room 17. you mean a lot to every kid in the class I know it I am extremely lucky to have you in 17. that's not it but it's just a perspective from a fourth grader thank you these are all the other letters I got as well throughout the year Peggy O'Neill following Peggy will be Gene following Gene will be Rhonda Williams go ahead Peggy hi I'm Peggy O'Neal a resident of Mission Viejo and I wanted to uh give a a big Welcome to our new superintendent Dr Brown I was reading about your qualifications your education your experience and I'm very pleased to see that you work collaboratively and that you support teachers Librarians and such I'm a firm believer in public education two of my nieces

029are Educators so not in this District but I see how well educated they are and how professional they are and how they left very lucrative positions in the private um world to become teachers and so I'm looking forward to see you work I'm sure the teachers that they're just an example of the professionalism of the teachers that we have as well so I um I look forward to watching you work collaboratively with them and that make this District even better than it is thank you foreign yes hi superintendent and board well I come to these as you know um I come to speak up for parents and grandparents who don't want the schools to sexualize our children and push gender grooming propaganda on them I don't mean any harm by this I'm looking out for

030my kids and other kids the books that I've seen the sex educ curriculum I've seen in this District introduce topics that do not serve the child's mental health it is more like a perverted sexual indoctrination it's really a sex education that promotes sexual promiscuity and experimentation it's such an education that opens up the child to Future abuse and sows the seeds of pornographic obsessions there's so much in the curriculum that has me fearing for the long-term mental well-being of my grandchildren it's a risk to send my children here what can you do to give parents the confidence that they will be informed of major events and decisions of changing gender thank you our next speaker is Rhonda Whalen following Rhonda Adam Kurtz and Shannon Kane go ahead Ron okay I got three things to say

031so I guess I better talk quickly welcome again Dr Brown we're glad to have you it was nice chatting with you um trustee Jones I really appreciate your reaction to hate speech and that you continuous continuously tell people how unsupportive you are so thank you continue to do that um third thing is we have pairs in the audience again today in the middle of their summer because they feel strongly that um our students are being shortchanged because they don't are other outside people don't have behavior training they don't know techniques to lift students they don't know how to perform specialized medical procedures I have to wonder if they even meet the minimum qualifications that our employees have to meet to work with our students so I just hope um that over the next several months

032that we can make some progress in changing this situation thank you Adam Kurtz good evening I've come for uh specifically it's come to my attention that there is a book in this District's libraries uh it's named blankets it's by Craig Thompson and it has some very uh explicit imagery inside of it and it's very concerning uh it has pedophilia it has child abuse uh and it's available to our miners and I wanted to bring it to the board's attention that it is in the library I believe it's in multiple schools libraries in this District I know it's at Tesoro and we have the imagery printed out if you guys want to see it thank you all in Shannon Shannon good evening um myself and the next three speakers are members of California parents Union our

033speech will be broken up into four parts and represent all of us as a whole last week each of you received an email with an attached letter in response to Governor newsom's egregious violation of an overreach of District control regarding textbooks and supplemental materials including library books two out of the seven trustees responded trustee belockus was extremely grateful for the provided resource and CCB honor correspondence with superintendent Dr Brown about discussing it this in this coming Friday's closed session and we are extremely grateful for that and I will let the next speaker Eva Harrison we had a little different response from trustee Jones with zero mention of Harvey milk's political affiliation or even one book title in our email and and in his response to TV USD trustee Jones respondus responded and I quote the

034president of Temecula Valley School District slandered the late Harvey Milk referring to him as a pedophile trustee Jones Goes On I'm outraged that any school board member would make such an offensive statement and I will continue to object vigorously if remarks like that are made um in an attempt to but you came here as to the documented history of Harvey milk's sexual relations as a 34 year old man with a 16 year old boy uh which is available on Wikipedia and otherwise she refused three separate requests to respond in defense of her statement even after sending the history as well as as the legal definition of pedophilia she was specifically asked do you disagree that he's a pedophile no response it's time that we start truly communicating other feedback additionally there was an inquiry about

035Library audit the question was met with response from cusd legal department referencing the Pico standard the Pico standard States the school board May remove a book if the book is pervasively vulgar there are still Books available within our district libraries that can contain pervasively vulgar material regardless of its title and protected class affiliation it seems that filing formal complaints may be the only way to get sexual content removed anyone who disseminates obscene material can be held legally accountable for Penal Code 311.1 sexual exploitation of a minor we are here to continue to ask you to do the right thing and to audit the libraries and remove inappropriate material we will be following up with each of you with regards to Friday's meetings as well as the town hall meeting with Mr Parham it's time to

036start a civil communication um and and discussion between all of us as a community and with the Forum as promised thank you our next speaker it's Amber Smith following Amber is Michelle quasel family you can't transfer to them it's in our policy that you know well I could talk fast okay the photos that I'm passing out are from the book in one of our schools uh this book shows graphic drawings of a little boy being walked into a room by a man then his pants being pulled down his naked butt being grabbed and then him looking down at the man's swollen sex glands per the book another graphic drawing is of a male masturbating another graphic drawing is two young boys with their genitals exposed peeing on each other another graphic drawing is a a

037guy sucking a woman's nipple I guess that's the right way of saying it um I am appalled that a public school staff member thought that this book was appropriate for minors I don't care if they're in high school it's not appropriate for any grade level the only thing that comes to my mind when I see material with obscene drawings and language and scenes is that we're trying to desensitize our children to sex the dangers of that is it makes them easier to groom next is the lowering of the age of consent we're seeing that right now in the California legislation our next speaker is Michelle fossil Campbell good evening it's a little weird to be standing here for the first time since I think April 2020. 044cusd school district regarding the wellness and prevention center for the selected cusc schools I would like to ask a few questions do these programs cover the IEP students the Department of Education has removed the requirement for schools to receive parental consent before submitting Medicaid claims for reimbursement on behalf of their IEP children how will you'll hand how will you handle the issue of parental consent for these students what regulation is in place to set standards of care and oversight which services are offered are the services provided to only the students are also the community at Large how are the parental consent and presence handled is there a beginning of the year when one-time single form is to be signed will the students information be withheld in the name of student privacy which laws govern the

045Health Data FERPA or HIPAA or both um are miners allowed to be medically treated without parent or Guardian present what are the guard rails for parental consent or parental presence during the time of treatment what age of consent for the students are you basing their treatment on age 18 or 11. what if a parent objects to the treatment what appears to be this appears to be an anti-parent agenda and recent Harvard study uh in conjunction with UC Davis they came up with the um uh opinion that through these uh centers there's going to be a higher rate of HPV vacs thank you our next speaker is Adam Brody following Adam is Maggie gates after Maggie we have Ryan so maybe for Mr Brody begins can a staff member get back to the last person who

047uh you know there were a lot of comments were made in the last board meeting about strategic kids and who we are I just want to say it's not true strategic kids is here to serve students to serve children since uh I graduated from high school because of all those who helped me while I was at these schools I've dedicated the rest of my life to helping kids wherever they are however I can start as a volunteer working at the Boys and Girls Club teaching chess there then through our company academic chess and today in 2005 I was teaching chess full-time throughout the district we gave away hundreds and I actually thousands of scholarships over the years I did any kid who couldn't afford a class we gave it to them for free and you

048know when the pandemic happened we found other ways to help the district with helping with the reopening and we had a lot of our staff who'd been teaching chess for us for many many years um and they were great with kids we're able to come in and help and since then we've been able to fill a lot of positions on a sub basis and we truly are doing this just to help kids and we're sending people in who are Advocates like I was we're not trying to take away jobs that's never been our goal it's never been our mission it's the last thing we want to do doing this has made me a huge fan of para Educators and all the awesome work they do I've seen firsthand the great work the parents are doing

049here in Capistrano Unified and we are with you at strategic kids we are not against you we are just here as Subs to fill in until a position is filled and I also want to mention right now we're running a camp for over 1400 children who are going to go for free here in the district and it's been amazing so many of these kids is the only camp they're gonna do this summer we have kids who now love chess who had never played before Camp started they're doing stem Lego really cool outside games and it's just been a privilege to serve in this district and I promise to keep serving kids any way I can thank you very much magnets good evening board members welcome superintendent Brown my name is Maggie Gates and I am

050the Labor Relations representative with the California School Employees Association which is a classified staff Union I'm speaking in opposition to renewing the contract with strategic kids for the 2023-2024 school year approving the contract will continue the practice of filling vacant classified para educator positions with contractors for a fourth year due to alleged Staffing shortages utilizing contractors in the classroom has deeply impacted cusd para Educators who are carrying more responsibility than this for the safety and workload demands of our students than what it is required of the contractors the Recruitment and retainment of para Educators continues to be a challenge for the district but the board has to ask itself why the district cannot recruit enough para Educators but strategic kids apparently has no problem with it in addition to the difference in workload that is

052mandujano I'm a para educator as well as the d-lag president for the cusd PTA say president of Marco Forster Middle School School site Council of Marco Forster Middle School Avid Foundation president and I'm here to just remind you guys you guys Contracting outside agencies is making an impact on our job because now we have to train people and we don't even get training I decided to become a para educator because I have a child with an iup learning disability so eight years ago I decided to quit my medical assistant job to become a per educator because I knew the impact and the help and the needs that those students needed so as the mother of a student with an iup I decided to become a para educator I do not want to quit my job

053I want to continue to get the training and not have to take the time to train somebody else when I'm not even provided the training so I just want you guys to take a look at that and know the kind of work we're doing the impact that we make in children's life and that we enjoy and love our job we just need the help and support to continue to stay as a para educator in our schools and continue to support those students if you guys were to take the time and to see the kind of work we do behind doors it's amazing we make that bond with the students and we give extreme support to the teachers that are working with their kids with special needs so I just want to thank you for the

054opportunity to speak up upon this tonight thank you my next speaker is Bonnie Bonnie veronical thank you following body we have Vicky go ahead Bonnie it sounds there we go uh my name is Bonnie by Ram cool I'm a para educator five at Palisades I've worked for capital for 11 years now I'm speaking today because our students deserve better and I request that you do not renew the Strategic kids contract I work extremely hard I am invested in supporting our special education students and I've always been so proud to be a cusd employee I like many of my co-workers have a master's degree in education and extensive training and behaviors I am so good at my job in great part because of the Capistrano autism training that I was required to take years ago this

055training and support from the district is no longer offered why is this I have seen the quality of our special education programs decline while other districts like Irvine unified have improved students and employees are leaving our district the morale of cusd employees is at an all-time low to use strategic kids whose only qualifications are running chess and Lego groups is unsafe and ineffective there's other issues some of these agencies have a two-year non-compete Clause that some of the workers aren't even aware of we had employees who wanted to work for cuscd when HR contacted the agencies they discovered they had this non-compete so they couldn't even work for Capo a strategic kids worker wanted to work for Capo but said I don't want them to lowball me another strategic kid's worker results had to work

056for Capo then one week ago he was told that strategic kids is looking into taking over all the YMC Portables on the school side so that they can offer their employees even more hours this individual will now not be applying to Capo because he feels he has more opportunities with strategic kids after 11 years with the district it's so disheartening that I still don't make a livable wage even though the work I do is so critical and essential thank you our next speaker is Vicky and following Vicky as Rhonda Whalen Hi how are you um my name is Vicki and I'm a parafive um technically behavioral support um I've done IBI and I've been extensively trained through the district we've done hours upon like 40 hours of Behavioral training um affirm modules and it's my

057job to go into schools I'm itinerant and help train the staff I'm allowed to train the cosd staff I'm not allowed to train the other outside sourced staff one of the things especially in special ed is that you have to understand behaviors that's number one I have a lot of people who don't know the functions of behavior and I've asked them um you didn't start it I'm not going to talk too long don't worry um no but just you know I've had issues where I've told them please don't respond like if it's attention seeking and you respond it's going to get worse so I've gone in and um tried to teach try to model it I can model it and then it wasn't being done correctly behaviors have escalated and then they asked to be

058removed from that child a lot of times they'll I've heard people say oh I don't do diapers well we're in special ed sometimes you have to there's certain things and I I know for the cusd employees that's part of our jobs like it is the care and well-being of these kids and behaviors it's just really hard when people are telling me that they're making more they would never want to be a district employee they're making 35 or we pay 35 dollars per person but then the para Educators start at like 18. you can make more money doing retail you know why would you want to come and potentially get injured and help having to deal with you know I do it because I love it but it's just making our jobs harder and it's some

059of them are great and that's I mean I'm not saying that I'm not trying to bash strategic kids because this man sounds like he has great intentions and that's awesome but we're not allowed to do CPI training a lot of our kids are medically fragile I have to be diastat trained what happens when they have seizures you know like there's a lot of trainings that our district provides for us so we have to have for the safety not just for us but for the other kids if there's behaviors I have to make sure that the other typical kids are safe also so there's just a lot that goes into our job and there's so many trainings that I've had that my co-works co-workers have had that we think everybody should have that is working in

060that industry and we are not allowed to train them so please don't please spend the money for the that your District employees rather than Outsourcing Rhonda Whalen I wanted to read a quote from the LA Times from May 11 2023. it bothered me the quote was from assembly member Kevin McCarty about the para educator shortage he said it's mathematics 101 they can work really hard to craft an amazing four-year-old in a TK class or they can craft the perfect burrito supreme at Taco Bell in some areas for thirty dollars per hour to me that's kind of a cop-out he this particular person is very um he's a leader in helping to get the state on board with TK and get that program up and running yet he knows we don't have staff Statewide to take

061care of this need I also oppose the extension of the Strategic kids contract I think that we are using them as a fallback and we've spent a lot of money on them but we're not solving the real problem and you've heard these Paris talk about how their training is more important for our kids it provides safety and it helps them learn better especially in the case of a you know Behavior problem we have pairs that have medical training to help kids in some of our classrooms those are things that strategic kids doesn't have and they have people who stand in a classroom and say oh I don't do that or I don't know how to do that that's not serving our kids so um I would really ask you to reconsider this contract and not

065versus diploma track for students with individualized educational programs known as iaps legislation for educational School counseling processes pbas review child finding other well-being related services to name a few finally we would like to commend the amazing cusd site administrators and their staff for engaging and reflecting and implementing of the cultural proficiency initiatives as noted in the addendum where all schools completed their cultural proficiency side goals based on the seven goals from the cusd cultural proficiency plan for the upcoming 22 23 24 school year school sites will continue working to enhance their cultural proficiency site goals per their success Educators thank you very much for the opportunity to highlight a few of the items in our cultural proficiency plan that are intended to serve the needs of all Capistrano Unified School District students if you have

070mtss addresses goal number one teaching and learning next slide please our mtss defines our system of support for students in three key areas all of which are critical to Student Success those areas are well-being positive behavior and teaching and learning the support that we provide our students is organized into three levels to personalize the support needed for every student tier one sports are provided to all students and are therefore described as universal tier two identifies targeted interventions for some of our students who need additional support and tier three is designated for a few of our students who require intensive support and be successful so this presentation tonight focuses on the mtss area of teaching and learning and the student outcome data that we share tonight are a result of all three tiers of support next

071slide please our mgss provides support for every student to achieve the five key competencies of a vision of a cuc Direction so that all of our students are empowered to be successful in their future endeavors when they graduate from our district those competencies are starting clock clockwise starting at uh two o'clock there Innovative Problem Solver inspired leader skilled Communicator engaged Citizen and continuous learning this graphic which was originally developed during the June 2021 board Workshop captures those five traits next slide please and Mr Shearer will now share our work with leadership development that directly supports our mgss thank you Dr Marvin so building a successful multitude system of support for students at each site starts with leadership as a district we've committed to supporting the leadership development of our staff for principals this has included

072regular coaching and support from their principal supervisor we've also shifted our principal meetings so that there's greater collaboration with other principal colleagues around data and effective practices we've also brought in Partners such as leverage learning and solution-free Consultants to provide training for site administrators and teacher leaders and we provide regular support for our assistant principals in our larger management system-wide we've made the establishment of a multi-tiered system of support at each School priority as you're all aware each school is a dedicated mtss specialist in elementary or PLC coach and secondary that helps the site build its system of support for all students this has been extremely valuable part of our theory of action we've also developed and provided sites with a rubric to help sites regularly self-assess their progress in establishing a highly effective multi-seared

073system of support we have increased the amount of time for teachers to collaborate around data and best practices as professional learning communities by providing release time weekly for elementary teachers as a result of elementary PE program and late start days and full release days for secondary Department teams and in supporting effective tier two and tier 3 instruction we've provided schools with resources and training Integrity or in Gillingham and amplify for elementary Reading literacy we've added reading and math intervention classes at our middle schools and we've added a paper online tutoring program for all students in grades through 12. so all these initiatives have helped provide sites with greater support time resources and Clarity in building a system that supports all students slime after work thank you so in addition to the systems and the trainings

074and the programs the strong and healthy partnership between the district office team and our school sites is critical so that our teachers are certificated staff classified staff and site administrators have the training Resources Staffing and overall support they need to implement mpss successful so one way that we measure this Partnerships through a principal survey we first implemented this survey in the fall of 2021 and we have administered it multiple times each year since then to measure our progress with this important goal our most recent survey was at the end of last school year in May the data comparing the first survey in 2021 with last may show that there has been a steady increase in the percentage of our principals who agreed that we are moving forward this to this towards this desired partnership which

075is focused on Student Success from September of 2021 to May of 2023 there has been a 21.1 percent increase with 90 percent of our principals now agree that we are indeed one team with a shared focus on our students next slide please so our next slide will be providing with the student outcome data from our ntss work please note we are sharing with you this evening our Benchmark our formative data which drives our work and informs our teachers and principles of progress in areas for improvement during schooling so the summative data the end of the year State testing data is not yet available so we will be sharing that with trustees once it's finalized and released to the public this coming fall so Dr Stewart's going to begin now with the elementary literacy data Dr

076Stewart thank you Dr Marmon Dibbles the dynamic indicators of basic early literacy skills is a set of procedures and measures for assessing the acquisition of literacy skills such as phonemic awareness alphabetic principle accuracy fluency and comprehension these assessments are administered three times per year K5 and in this chart you will notice the end of the year comparisons from 2021 2020 2021 through 2023. Positive Growth syndicated in green and declines are in red you're extremely proud of the progress we have made with our socially economically disadvantaged student subgroup we indeed are in closing the achievement Gap this group has achieved over double the growth of our all student group you will see that English Learners are in red while many are English learner students are redesignated every year we are comparing very different groups of students

077this group will continue to be an area Focus for our professional learning and support in the subcoming school year however you will notice that once redesignated over 94 of our former English Learners are meteor exceeding Benchmark and reading at grade level next slide this next chart is a comparison of this past school years beginning of the year middle of the year and end of the year results for our primary grades cage or two you'll notice that at all three grade levels there was a significant decrease in the number of students that started below grade level yellow and red from beginning of the year to the end of the year conversely there was also a significant increase in the number of students at grade level or above which is indicated in green and blue next slide

078in this chart you'll see a comparison of this past School Year's beginning middle of the year and end of the year results for our upper grade students three through five similarly you will notice that all three grade levels have a decrease from beginning of the year to end of the year and the number of students have started that have started below grade level yellow and red one anomaly that you may notice is the decline in the fourth grade data from middle of the year to the end of the year this data is consistent with previous years fourth grade scores and it has been discovered that the end of the year passage in fourth grade is a significant higher grade level than the middle of the Year passage the middle of the Year reading passage is

085Pizza in the spirit of continuous Improvement the education support and services team will strengthen mtss in the 2023-24 school year through the following training and resources training in curriculum and instruction for teachers and administrators examples include irony training for administrators continued work with the Irvine math project and 110 secondary math teachers will be participating in a book study on building picking classrooms training and resources for teachers administrators to support English Learners and students in special education the curriculum instruction team will be focusing on the great first instruction strategies of language routines in math to support multi-language learners regular release time for teachers to collaborate review data and hone instructional strategies with their plcs will continue through release days for secondary teachers in the PE program for elementary teachers a focus on key curriculum standards and

088the scary thing too is that I often hear public comments before this board as we did tonight the challenge the transparency of this district and its Educators when really what they mean is they just don't like the honest transparency that they're hearing and sometimes the most expedient way to disagree with something you don't like hearing is to so doubt in its source to make the claim that there is no transparency allow me to clarify transparency doesn't mean agreement transparency means honestly laying all your cards on the table to create an atmosphere for discussion and hopefully an ultimate consensus that everyone feels included in making remember what I said before inclusion versus tolerance the new term is inclusion tolerance says to me as long as I get my way I'll put up with your different ideas

089inclusion however by its very nature includes compromise and consensus this basically defines mtss this clamor you've heard from some tonight is a purposeful misdirection those who don't like what they're hearing allow me to be transparent we proudly say the Pledge of Allegiance every day in all of our classrooms America is a great country because of our public education for all and I will tell you that in the last 10 years of my career I feel strongly that our students feel safer and more included than they had in the first 20 years of my career that's collaboration inclusivity transparency mtss Welcome to our district yes or no it's time for a trustee discussion on this um anyone want to go first I'll I'll say something brief um we don't have year-round learning or classes in the

090school district but I wonder if some of the data suggests that I'd be curious to see how it Stacks up with those school districts that have year-round schools because as most parents are seeing including me my kids pretty much have forgotten everything already and those first couple of weeks or months in the fall you know they're going to be in the yellow and the red um and I wonder how does this is there you know uh research that you've done to consider whether year-round options are a better scenario and you don't have to answer that right now but I think it's worth the discussion but you could answer it if you want and I worked at a year-round school uh firm 10 to 15 years I didn't notice a huge difference um you know and

091part of it is that the assessments going into the next grade level increase in return so you do see it drop off even I mean there is a summer slide that's true but I don't know that it's I didn't notice that was significant as an educator here in school I mean there's some but then you suck to take time off So then whenever they take time off with a little bit of slime so yeah just one person's opinion but we can certainly we can certainly look into it and do a comparison yeah I mean I don't have I don't know that that's the answer I just um you know I wonder if the data shows like that you know maybe the testing in the fall is overly aggressive you know it's just when it's clearly

092every every example shows that the excel in the spring versus the fall when something's wrong with the test you know so it's a different measure you're not taking at the beginning of fifth grade the same tests that you took the at the end of fourth am I right so it is you are now in a different grade and you're being evaluated on some in a different way um I I I have my own anecdotal anecdotal story and I don't believe in using anecdotes to make decisions but my daughter-in-law is a fifth grade teacher uh in a year-round school and during copen they eliminated the year round and taught only the traditional schedule and she has observed to me I don't want to tell you how many times how much more learning loss she saw in

093her classes when they had the whole summer versus when they had the short breaks and by the way today was their first day of school um so they are back after a relatively short summer and then there will be breaks at other times so again it's just an anecdotal story but um but I think it would be interesting to look at that school and I can tell you more about it and see what their test data was in those years versus the previous and subsequent years no I was just going to clarify and trustee Jones kind of nail on the head so a better way for us to think about it and we can do this think about them on track so when you look at those yellow bars often as a student moves up

094to the next grade level being in the yellow bar is not a bad thing if you were a fourth grader and you're taking the fifth grade test yellow means you are still a fourth grader well if you haven't done anything since fourth grade that's acceptable so the really the look at for us is growth over the year um so I don't love the yellow color that's what everybody uses um but yellow at the start of the year is still fine it's on track though they're not here any other discussion I have a question for um Dr Stewart um you I was really interested in uh the discovery that the mid-year passage uh was uh or the end of year passage in fourth years and fourth grade was more difficult uh or significantly more difficult than

095the uh mid-year and that's not our test correct that's a test from someone else correct um have we advised whoever make okay all right so we are in addition to it also being in a fifth grade level um that passage is also written in prose which is also difficult for students of that age so because it's not as familiar as regular um informational or uh non-fiction texts it is more difficult for them but yes we have reached out to University of Oregon and Wilson um have been in contact with them regarding that and do they see him at all interested in what we have to say are they just like yeah yeah thanks a lot uh Mrs Bears could you answer that question um in more depth if she wanted to but um they are

096they are aware uh they have acknowledged it what we have done with our teachers is in that acknowledgment understanding that part of it isn't just a great level of the text but also the way that it's written so making sure our kids have more exposure to that type of um reading I think is also supporting because year over year we are we are making growth um we just consistently noticed that decline from Moi to uh to eoi okay I appreciate that and you can't see Mrs bears but I can and she brought her my closer um I can't add much to that they have not acknowledged it and it um the data is the same Nationwide um I don't know that we get Yeah Yeah from them but we um they haven't made any changes

097so I am sure it's a whole research team that would have to make that change I don't know where we are with that but they're aware of the problem is there is so much research goes into settings got points to change their passages they're probably a big deal for them but I think what we've done is add a more exposure right and made them aware of our concerns right but also added one exposure for our students in the classroom that act style right right I had a question on slide eight and 17 but I think you pretty much covered they think all right or rather I would like to look at it just a little bit closer and oh man you know I'm just gonna I'm gonna pause it thank you and I think you

098covered all my questions about slide 17s I think so I hope this isn't like a brain teaser but so it was a board meeting we had we first started launching you know doing mtsf and starting our reading uh interventions and we had to go upstairs or we had to go where did we go we went upstairs right and there was a data point and it was probably midnight or one o'clock in the morning and it was I remember being blown away and and you all corrected that data point but basically it was um I have this wrong and I um believe Mrs Lyons helped present this um it was when we had started we were seeing a reduction so I don't know if it's we actually have the data of I think this would be

099Elementary of requiring that's not the right word but an IEP designation once we had started do I have this right as nobody remembers this but me at midnight Okay so okay then just forget I said anything but it seems to me that we had a it was it was it was about the reading interventions and we were able to see the the reduction because you know parents were want some help a specific help and so with that we were able am I right yes thank you yes nice work and a great great memory so we were when we first started uh measuring in the success of mtss we were looking at the initial referrals of students for special education and what we what we realized is that you know we were we were saying that

100that measurement should show there are fewer referrals if the mtss is doing its job but and I'll ask Mr Collins to expand on it but the fact is that we actually get done a far better job of child find through this process of supporting kids and the training we provided now that has actually increased the number of referrals but it should because we're actually identifying them better than we ever did so we then didn't include that as a measurements because it's kind of a false it's a false negative or false problem I mean the way it's just not a great measurement to say is mg says working or not because our child find is improved through mtsness which means we're identifying a student would you saying things yeah and that exactly that's the exact point

101is getting a lot more early intervention and because we're doing more early intervention we're able to identify students that have these these risks and needs that were kind of previously fallen through the cracks we're now identifying the earlier so some of our initial identification specification has gone up because we're doing such a good job of that earlier intervention and catching some of these students early on so you're not crazy well that's debatable that's not on the agenda tonight it doesn't prove it um Judy any comments on this item thank you hearing none okay um then there's no vote this is an informational item only so no board action is necessary we'll move on to the next item uh 1284 um I'll recognize Clark Hampton Deputy superintendent business and support services thank you vice president our

103by roll call vote we'll move on to 1285 and I'll recognize Clark Hampton again Deputy super team of business and support services thank you guys vice president so in 2013 for uh the cfds in Talega there were some refunding bonds issued in 2013. they were not callable until this year and so now they're called so there's an opportunity to refinance that debt and uh Keith Weber from government financial services jpa is here to present the item for your consideration thank you great hi good evening and thank you so much for having me back here tonight um so just very briefly I have an information presentation for you discussing the refinancing opportunity for Community facilities District 90-2 recruitment area 2002-1 um so to start uh we have some background and um that background will be about

104the cfd as well as the bonds I'll briefly touch on the opportunity that we have to refinance these bonds and then wrap up with some some next steps so the history is that this uh cfd in Talega was formed back in 1990 the Improvement area came later in 2002. and it's about a thousand Ninety Acres about half of the larger uh 90-2 cfd and in 2002 when the cfd was formed uh 50 million of Bonds were authorized and those were to fund both school facilities as well as improvements for the city of San Clemente and you can see there's about 3 200 residences in 90-2 and about 1 800 residences in the Improvement area 2002-1 so just Orient yourself uh on the left hand side here we have a map of the district and the

105cfd is shown in yellow and on the right is the cfd boundary itself in purple is the Improvement area and both the purple and red areas combined make up the larger to Legacy FD so in terms of the bonds in 2003 just under 50 million dollars of Bonds were issued these are then refinanced in 2013. we saved about 12 million dollars in debt service at the time and as Clark mentioned our call date which is our first opportunity to repay these bonds is coming up on September 1st and so that's why we're bringing this forward to you at this time in terms of interest rates you can see a market index here and even though interest rates have gone up over the last couple of years they still remain lower uh in this in the

106bond market and then they were back in 2013. so the market is less now which signals it's an it's an opportunity for us to think about refinancing and this next slide is just to share some insights into how we think about refinancing we're showing here the interest rates on all the bonds that the district has outstanding compared to the current market and um one of the three that are meaningfully higher than the market uh the uh the bonds for you that we brought forward for you tonight has a holiday of this year the other two that are being shown here I have causation 24 and 27. so those are we'll keep on our radar and of course we'll keep monitoring monitoring this as we go forward um in terms of the bonds here so you

107can see the dash line is the cfd revenue that we collect and the uh the bars are showing our cfd payments we try to help ensure that there's enough Revenue to meet those payments and the revenue grows at a two percent escalation rate we currently have nine years left uh before these bonds will be paid off and then showing here's our estimated savings so if we refinance we think that the uh the bonds payments will get cut to what's being shown here in a dashed Green Line our interest rate will get cut from about 4.8 percent currently uh we're estimating to 3.46 about three and a half percent uh this will save us a million and a half dollars for our taxpayers now is this enough savings we look to government Finance officers best practices

108as a guideline and the suggestion is uh that we have a metric of at least a Net Present Value Savings of three percent or more of the bonds that we're refinancing this is after all expenses so if we look at this metric we can see here we set um uh the the minimum three percent we're estimating we're at about 4.28 so we do exceed the metric um and so we are recommending that we go forward and your resolution does set this metric of three percent as a minimum so if we don't hit that minimum we don't proceed we we uh we delay now in terms of taxes um we are hoping that we'll be able to lower taxes as a result of this refinancing um you can see here and at the bottom table a

109history of the cfd taxes for both 90-2 as well as the Improvement area back to 2012-13 and you can see our taxes are well below uh currently well below what they were in 2012-13 and they're also well below the maximum and our hope is that we'll be able to cut these taxes even further with refinancing we're estimating that for this upcoming fiscal year if we don't proceed the tax will be a thousand nine hundred seventy eight dollars on average per home and uh with the refinancing we're estimating that'll get cut to 1 885 so 93 dollars per home on average and again that's per year so this will accumulate over time um so in terms of of uh process we are recommending a um competitive bid process as opposed to doing a negotiated process again

110this is based on best practices and if we look at the history of our bidding here in the district since 2012 we're showing a table of all the bid results the district has received and what you can see is that in general there's been several bids for every financing there's been different winners that have been the winning bidder and I'm highlighting in here the last Bonds on the Improvement area back in 2013 and you can see the difference was uh 2.6 million between the the wind the the high bid and the low bid um so big big difference there and some reason to think about uh bidding again this time so in terms of next steps um you do have a resolution for you tonight for your consideration that will authorize us to move forward

111with the refinancing approve all the documents and uh with your approval we would have the bond sale next week where we go out to bid we lock in interest rates and it's a bit of an accelerated time frame because again our hope is that when the board considers the cfd tax levies on August 16th will have been able to both report back to you on how the refinancing turned out as well as be able to include the lower cfd tax in your materials for consideration and then we complete the refinancing on August 22nd and again September 1st is the call date so thank you and happy to take any questions up I'll go ahead and start um since it's up to me to decide who goes um first I want to thank Clark for saying

112the magic word which is these are callable now and they weren't before so right I had a bunch of questions before and I just didn't understand why didn't we do this before now seems like it's a terrible time time to do this but that answers all that you know we had no ability to pay off these bonds they weren't callable until now so that's right um in the future just you know say that and I'll leave you alone and I do understand times of the essence this is not something you want to take down and kick the can down the road yeah um and you know I'm I'm very I work for a bank so I understand a lot of the stuff that goes on and I'm very concerned when Bakers show up with a

113bunch of new gizmos to convince school districts to do things and um and that that's not the case here this makes all the sense in the world even in a high interest rate environment I look forward to lowering our taxes next month um unfortunately the reality to the actual homeowner is they'll still be paying more taxes because they're assessed rate has gone up so you know it's it's not really fair to say we cut taxes 93 dollars because they're not going to see that yeah when they what they see is going to be an increase rate assuming that their assessed value which went up which it did yeah if I could just comment on that so this tax is not uh based on assessed valuation like the general property tax um so you're right people's

114assessed value may go up um but this tax would not go up with assessed value um so we would we would get to see a reduction uh for this particular tax even if the general property tax happens to go up yeah okay great these are based on square footage yeah there that's there's some broad categories but those categories are largely based on the square footage of the home okay any other questions of their tax bill this this is a separate item right um so they see and that's it's always been the challenge on their tax bill they see cusd right um and I mean I feel like we're back in time uh sitting here going down this path and I appreciate that we did we never got any traction for it yeah um no one's

115ever given us reward we did oh yeah we did we won a rose that's right um so they will see this it's not like I believe one year didn't we at one point we gave the money back like they got money back um I think that was I don't remember what year that was doing that I thought they got they got a check yeah I remember interesting um but just just to reiterate when we do this work we've been doing it now for a very very long time and you've been here with this thank you yes thank you um it's obviously a cost he's a cost but the cost is covered right when we refinance okay um all right well obviously I support this and one of these days they'll go oh let's let's hope

121difficult positions sure I will start and I'm also joined here today by Christina Giger our executive director of classified who's done a lot of the legwork for this effort so to start off last year at this time we had approximately 190 vacant para educator positions this year at the same time we're at about 180. well it's only a 10 difference we also added approximately 40 para educator positions over the last year so we are making progress in that area we currently have 29 offers out to para Educators waiting for them to accept and Christina Gagarin our executive or I'm sorry our HR staff has conducted close to 80 interviews over this summer for both para Educators and our campus supervisors to over hard to fill areas we did start our employee incentive sipin where right

122now we have 51 pending employee referrals items to come in and 17 of those are for para Educators that have been hired we do have a job fair next week that we've advertised we we've also brought in our TV screening in-house where they don't have to go to a clinic which helps us move quicker also about our fingerprinting in-house and um reimburse employees for all of our hard to fill again finding that was a barrier we've streamlined our paperwork we've found that not everybody has access to a printer so we're able to get all of the paperwork done quickly the improvements to our job fair we do have the TB and fingerprinting actually on site so for our regular hires they do need to go get fingerprinted at a location but we are since we

123do have so many attend our job here who are able to bring the fingerprinting in also we have administrators on site during our job fairs where we conduct reference checks right away so we're able to make job offers by that afternoon or the next day those are some of the things we've done for this year that we put into place and we will continue to work with all of our efforts to get those filled some other things to be clear on strategic kids strategic his employees have never filled a regular position on a permanent basis they fill in for substitutes when we're not able to find enough substitutes so in most districts probably for the past decade finding classified substitutes has never been successful in getting a pool enough to cover substitutes so even when

124all of our positions are filled we will still need some type of substitute whether they're our employee or a contractor just to cover our employees when they're out ill or take any other time off uh another mentioned outside there was the no compete clause with strategic kids we do not have a no complete cause with strategic kids Mr Brody has asked us to that his employees give him two weeks notice before they start working for cusd which we would assume our own employees would give us two-week notice before they left and in fact we have hired several of Mr Brody's employees and that has been where a lot of our employer employee referral stipends have come from elementary office managers and middle school office managers have met the Strategic kids employees and encouraged them to

125apply to take regular positions for us in cosd so to be clear when we come up with the Contracting out of regular assignments there has not been one strategic kid or contractor in that area that has covered a regular assignment if solely worked as substitutes Christina did I miss anything thank you thank you for the clarification um especially about that they are substitute so on that vein uh could you if possible address that training component because a substitute in our special ed classes is much different than being a substitute in the gym so do we how are they supported because In fairness to the Strategic kid kids at play um is there a crossover what what do we know about them when they come in to substitute say if I'm the teacher and they're coming

126in my class okay so for a classified substitute is a para educator there is no formal training other than making sure you met the minimum qualifications for the position similar to a certificated substitute teacher they're not trained in any specific curricular area classroom management we give them a clinic when they start but they're really filling in on a short-term basis Mr Cody does provide training for his employees but for as a substitute we wouldn't expect them to have mastered every level we did hear some of our para 5 educator repair Educators speak tonight those are the ones who actually provide training and support to all of our staff strategic kids contract Subs do not sub for para fives so when we're talking about that level of work there is no substitute for a para educator

127five we need a para educator if I'm in that role last year at this time we had 14 para educator 5 vacancies currently we have seven with nine pending interviews our goal would be to start this year with all of our para fives in place um I have a comment you know I I feel that it's being perceived as a vote for strategic kids is a vote against para Educators and that's absolutely should not be the case I I think um the concept of this is to fill the path and it should be a short-term solution um but we really do need to do a better job filling the vacancies with the pair of Educators and having them be employees of the district and not outside contractors I want to definitely go on record uh

128saying positive things about strategic kids I know they run a wonderful program they've been unfairly vilified over the last few months and I appreciate the um the founder coming here to speak today my kids actually did it this summer and it was a great experience but it doesn't replace having a employee of the district there you know all the time and you know I'm I think it's a slippery slope when you go out to outside vendors to solve your issues we need to be doing something a little bit different in order to get the people we need this is a tough tight labor market which means we've got to step up a little bit so that's that's my view on that but I'll approve I'll vote for this because I know strategic kids is a

129good program but it does not in any way suggest that I don't support our our goals to bring in more very educators any other comments uh Judy um I wanted to add additional comment that our para Educators have made is because and parents alike is the consistency you know by not being able to build these positions and then when we use a third party um it's constantly a new person it's not the best thing for a student so I appreciate and I have read and uh um Dr Presley has shared with us all of the measures and all of the changes and everything they could possibly creatively think of to to get the hiring done but I would like to ask uh Mr Presby is there something else that we really need to do that

130is holding us back um and is it wages in terms of this category you ask the question I think about probably 24 hours a day all of the time and in fact many of the Innovative things we've done have come from weekend brainstorming possible solutions wage increase generally does improve higher that is to say I'm not agreeing or disagreeing that that will be the solution last year are lvns were ranged up five ranges which was 12 and a half percent and then the board approved a 10.25 increase on top of that last year at this time we had 23 lbn vacancies we currently have 21. so I can't say that increasing wages will now have our staff completely filled but most research in labor markets do show that higher salaries do generate more applications one

131comment about the Los Angeles Times reference that Ronald Wayland had made that clearly shows this is not a cusd problem every school district is struggling with trying to bring in employees and when we do talk about comparison to I don't know if it was Taco Bell or whatever fast food restaurant there are other considerations in total compensation that are not clearly relevant on all paychecks right now the purse contribution is 28 percent so every dollar paid the district contributes 28 cents towards their pension that generally is not matched by fast food restaurants where when an employee is looking at their take-home pay that doesn't mean a lot when you're just starting in your career but a school district does not have the option to not pay the purse most employers do have a Health and

132Welfare plan now especially if they're over 30 hours school districts health and aware about our plans especially in Capistrano is an excellent plan that is generally more expensive than what a private employer will offer so we are looking forward to sunshining our negotiation proposals with CSEA we will be at the table at Health and Welfare and salary will be open so this fall we are able to engage in conversations about increasing compensation second question is not a substitute but does the parent educator need to take the C best test thank you I'll answer that yeah there are several ways that a para educator could demonstrate competency one is 48 units at a university level the sea best is an answer and also our competency exam that we offer here there is a fourth and it's

133if you completed I will don't quote me on this one but I believe it's two AP courses while you were in high school to thank you Michael I knew you'd have it also it could be a fourth way that is available but is rarely used so if there's the units bachelor's degree the CVS they're able to come in competency exam or the AP okay okay they're trying to help us because they've raised all the fees for those in California for this year uh 2023 so as you said it's not just being me with default because all over um and so I was just wondering if and do we not have any other category of person that if we take them time and a half to fill in a spot that is at least within cusd

134do we have any other category of employees that we could after work is one of those open plots uh while we're trying to film s so if I'm understanding the question correctly you're looking at a different employee who's not working those hours who would be paid overtime to work those hours is getting a certain amount but then employees versus him actually in the savings that amounts um trying to find someone within our organization that it was available okay I understand the question we would need to do more of a cost analysis at this time I would guess Clark is next to me in case I'm wrong that an employee getting time and a half would be less than strategic kids what we pay on that rate however we would need to find somebody who has

135the para education qualification who does not work during the regular school day so that would mainly be our custodial staff in the evenings is the only group off the top of my head who does not work 180 days during the school day okay thank you um I'll just add one last comment which for me which is um these para educators are with many of the most disadvantaged of our kids and they're kind of the first line with them and uh the risk of things falling through the cracks is even greater when we're understaffed so there's a financial cost um behind that so probably could outweigh any any wage pressures so that probably sets you up for your negotiations really nicely thank you vice president Parham I appreciate that trustee Jones so um a couple things

136um there was a statement made about a rumor that uh strategic kids want to take over our wives our YMCAs and I I mean since the YMCA has owned the buildings I don't know how they're going to do that but uh do we do we know anything about this um I mean that seemed like an extremely odd question um we don't have any information on that and Mr Brody was laughing and shaking his head during that time so he wasn't laughing I think he was just shaking his head okay all right thank you very much um okay so this these are how we're going to get started um and you know no one wants subs and anything I remember when I was in school and you had this sub and they would you would tell

137them a different name and you know all kinds of crazy things that people did to Subs um and I certainly understand the issue of consistency but the reality is that people are sick and they have to go to court and they have to do all sorts of things and we need subs so our shortages I mean we maybe have not hired everybody yet that would be a a regular para this year but we we are looking for substitute pairs right that is what am I correct that's that's what strategic kids is doing they're providing substitute pairs correct and then when we want another initiative we started this year is we do every Thursday para educator introduced centrally down here at the district so anybody who applies within the four day period is interviewed on the

138fifth day occasionally we will interview somebody who we do not feel is qualified to step in as a regular para educator but needs more experience will recommend them to be hired as a substitute where they can start to build those skills and find the school that they would like to work at reapply to be regular and then they would receive the training and become part of our staff okay and that sounds great um but I guess I want clarification on we we believe that by the time school start starts we will have substantially all the full-time pairs that we need or regular non-sub pairs we do not believe that we do not believe that okay okay last year we started our school with approximately 160 para educator vacancies which is an improvement even from 2015

139where we were close to I believe 190 vacancies pre-pandemic this isn't a new problem okay but I'm impressed with my staff and HRS by taking innovative solutions to a very long existing problem in hopes of making Improvement which we are starting to see okay I understand um yes yes okay so I do understand about that um and you know there as go to any company and still see that they're hiring and there are labor shortages I mean that's just a fact of life um you know my concern is that some of the people here tonight are saying don't don't extend this contract but there doesn't seem to be an alternative uh uh like no I'll do it instead or whatever that I I mean we are trying to fill these positions and if we do

140not uh renew the contract we are going to be legally out of compliance with all of with our needs for some for parents so I mean we have if someone had an alternative I would be interested in hearing it I do not see what the alternative is to renewing this contract I mean I literally don't see that maybe I'm stupid but I don't see what it is so anyway um thank you superintendent so it's been a while since I've looked at this how many are those people being born how many are there with this I'm sorry what kind of Errors right now oh close to a thousand around nine hundred a thousand how many hang on okay Clint he's looking it up let's usually these 190 numbers but there's no I don't know what that

141means there's no Baseline what kind of hole is that how do you generate that number of employees and it has it it seems like it's a problem a lot since I was last on the board and I know there's like there's some students right so we're not we're going to have a slightly problem going down students and hiring more hours right when Clint pulls it up he he actually did this this week we'll talk about our students increase with IEPs and needs and pair Educators okay and while we're at it can we if if it's possible and this can be ballpark like how many do we have or how many positions are there now and how many positions were there like six seven years ago so if you look at the numbers for a pair

142of twos through fours pair two pair three pair four which are special education pair Educators not counting the parent educated ones which are like the general education PE para Educators um as of May of 2023 a couple of months ago we had 852 that's not carrying the pair of fives which we had talked about the most highly qualified there's about um 45 so you add those into there about 900 pair of twos through a pair of fives again not counting the pair of ones I mean if you want to ask um previous years if you look at May of 2023 just now the 852 you go back to May of 2015 so you're going back eight years we had 660 of that pair of two through four so it's about 190 increase that also aligns

143with our increasing special education numbers from Over the eight years we've increased 1500 to 1800 IEPs in general as well so that kind of correlates to the increase in pair educator numbers is so just just to clarification that's 852 positions but when you when you break it down to FTE the full-time equivalency is 607. so and that just kind of gives you a little more because some of those are 17 half hour positions some are 30 so if you actually equate it to FTE yeah yeah but still but it's still from 2015 to 23. right but you're right over the over time it's you I would hope that we're at our Peak because I think one of the things that we've seen over the years increase in higher educator one-on-one support with students and we're

144really trying as a special education department to appropriately staff our classrooms so that there's less requests for one-on-ones so we've implemented this last year a skia process which is called uh stands for special circumstance instructional assistant assessment and that actually goes through a process a 60-day process to identify the student needs that additional program support the one-on-one support um and using that process we've been able to eliminate 40 this last year requests for one-on-one support so we're trying to really Implement that and also appropriately staff our classrooms so that we have the amount of pair Educators in the classroom that's needed then some of those behaviors hopefully are decreasing and there's less of a need for that request for the extra one-on-one support so out of those 852 positions a significant amount almost half are

145one-on-one support so we're trying to lower that number as well by appropriately Staffing our special education classrooms and trustee Richard you're right now we definitely have declining enrollment and growing uh request repairs just this week's staff took action to try and readjust some of the classroom Staffing ratios preparers in order to try and mitigate some of that and get this teachers the support they need without having one-on-ones for each kid um that are not necessarily always necessary if they're necessary we definitely want to have them um so so but also to kind of bring it back as a summary you think about the number of open positions it's been a moving Target right so the fact that we actually have fewer open positions but more employed people uh HR has done a pretty good job

146of really trying to hire as many people as possible in an expanding market for us basically while minimizing losses If We Had State at the same number we had six years ago we would be fully staffed but unfortunately that number has grown um so the fact that we're we're closer is good and they're going to keep working on it real quick so just and I love all this information it's very helpful um just kind of in a simplistic way so we're really continuing to basically audit right or what are our students need I had a someone talked about uh being at a class at Dana Hills there were 10 kids in it two pairs and that was it and then the teacher so I mean it seemed that's the and these children didn't present in

147any way necessity necessitating to Paris right so I you know I'm worried that you know I mean as a parent I would I would ask for that and I would want that so so I guess you'll just continue to to look just to make sure like I guess again auditing to make sure we are are stopping correctly yeah correct we have a base Staffing ratio for each type of special education program in our in our district so if we're looking at at Dana Hills as say a steps classroom steps okay so just just for an example steps classroom would have a base of two pair Educators to support the classroom and then one-on-one Parish kids are outside of that ratio kind of on top of that um for a more of a specialized academic instruction

149have said please share a little bit more about that you know what we're doing yes thank you trustee Davis so to clarify for those speaker this evening a couple of things first this is the Second Amendment of the wellness and prevention center uh joint use lease agreement we've been this has been since 2018 was our was 2018 was our first amendment to this we've had this for many many years in the district and uh we have overwhelmingly positive feedback from the site administrator's staff the the students the families regarding this additional support that they provide um as it says in the board record that's basically increased accessibility to Mental Health Services so it's above and beyond what our counselors are able to provide and it includes prevention education therapeutic intervention post-substance use Education Services and

150in-class education so this speaker was asking what what is it so it's not a I think there's confusion like it was a Wellness Center similar to things we heard back in the past regarding vaccines and different things from the county this is not that this is the wellness and prevention center um the speaker asked about parent consent absolutely spelled out clearly here on page 13 number 22 parent accept Services very clearly stated that parent set is required and I'll have uh Mr Graziano speak to that in a moment uh also the speaker asked about FERPA and HIPAA and absolutely it spells out that it follows both FERPA and HIPAA in the Amendments so that is on page three of three of the description of the additional programs in the amendment so I want to definitely

151um you know the issues that the speaker brought up there they are very clearly addressed in this this is very well received by the schools that have this additional support for their students and their families Mr gross and anything else on the like the consent and the way they communicate with the school Dr Moore was correct the information that we have received from the counselors and Ministries where this is at they say the same thing that as a collaboration if something is is occurring with the students they they have a complete open line of communication with that and uh like I said it's been a great partnership with them and everything that Dr Murphy would say that's correct about the services they provide for us just like to make a comment the wellness and prevention

152center has been one of our most amazing partners for children in this District um they have been up until a certain point totally Grant funded um and have continued to offer a high level of service and support for our families especially starting in the San Clemente area I'm very proud of this District that we then realized um what they bring to the table at such an amazing cost well we were able to add them and to fund them at Marco when you ask that principal there I just did passing said hey how's it going she's just stopped in her tracks and said this is life-changing they're able to counsel children and their families they're able to operate in a capacity that are existing academic counselors and guidance counselors cannot do um this organization is incredible

153and I'm actually very vexed that a person would have drop a bond like that and denigrate this organization and then leave so if nothing else it gives me a chance to say how powerful this partnership is I am thrilled that we are adding San Juan Hills High School the Continuum of services for children whose needs are only growing and they deal with things that is almost unbelievable to for us to understand so I am excessively grateful to the wellness and prevention center um and we will I'm just and I thank staff for continuing to utilize that because they're amazing so thank you trustee Hannah Jack can I also jump in and say and again if we recall CST carers at tiers two and three include specifically Wellness Center prevention stuff okay so I'll piggyback on
