016last airbender hosted at our school which included carnival rides and plenty of food to refuel after coming off the dance floor all of our students were pleased with the entire homecoming experience again and in our halftime show for homecoming we had a huge participation in each class as it's every student's favorite activity and a nice introduction for the underclassmen as they may not have ever seen one before our pep rally held outside in our stadium hosted all of our students in one pep rally instead of our usual two hosted in our gym it was a huge success in relation to spirit as every person was immersed in the same environment this past weekend we had our tangled theme winner formal which included a coffee bar video games a ferris wheel and many things that piqued
017all sorts of students interests as a student body we believe in the importance of our future students holding our annual future title night for football pep squad and marching band and abundance of elementary students worked hand-in-hand with current solo attendees doing what they love as they run onto the field we also had our eighth grade open house allowing students to walk in the shoes of tesoro student meeting with future future teachers of all departments exploring the campus and even meeting people in their certain sports electives and after school activities currently during this event asb worked with our amazing impact program these students focus on current freshmen helping them get their feet planted in high school through school events on campus and a helping hand when needed tesoro has a very active social media presence with

019up of students from various groups on campus who strive to build an all-inclusive school climate and stop all forms of bias and bullying one goal of the coalition is to work towards earning the designation of a no place for hate school as we come across the seniors most exciting part of the year we have our senior week this week also consists of our senior luau providing shave dice and food trucks senior spirit days like senior citizen day and college sweatshirt day many delicious food opportunities to give our senior class and this year we are implementing a senior movie night on our football field as for all students we have our infamous dodgeball tournament clash of classes spirit week and pep rally awards nights and of course for upperclassmen prom tesoro is committed to building relationships
020on and off campus constantly striving to better our school and making sure that each and every student has their own unique experience pursuing their passions on and off campus through athletics academics performing arts school events and other programs it is my greatest honor being a part of a truly amazing school representing the students of tesoro each student and staff member are all vital pieces of this big titan family so many students can call home this year being my fourth year in asb has shown me the dedication and the behind the scenes work put into the outstanding education that i and so many others have received in cusd next year i'm hoping to continue my studies at a four-year university studying psychology feeling confident in the next chapter of my life as a result of the
021guidance and preparation given to me so i wanted to thank you all for allowing me to represent the place that gave me the most unforgettable four years to solo high school thank you hello question everyone i almost didn't get past a year's worth of free pizza oh yeah that was a big hit okay did somebody make it the halfway shot wow i know we continued and gave them gift cards but it was like probably the third game that we did wow yeah i'm impressed for all the rest of it too good job thank you um now for uh board and superintendent comments um great good evening and welcome to our march 16 2022 board meeting i know it's unbelievable but after tonight we only have two more board of trustees meetings until the end of
022the school year we've been through quite a journey together this year and this week especially we're seeing more real steps back to normal monday was the first school day under new guidance from the state that highly recommends mass but no longer requires them our principals reported lots of smiles and grace and understanding for staff and students who still wish to wear a mask it is each person's choice and we respect that this coming weekend we have the cusd music and arts festival at capistrano valley high school parent volunteers and visitors will be welcomed back to schools beginning next monday following cdph guidelines we're planning end-of-year school events and graduation ceremonies our young people are focused on their academics and well-being that's our collective focus on teaching and learning it must be to get our students
023across that stage into the next grade level and prepare for what's ahead last week we celebrated our teacher of the year event for the first time in person in over two years i'm so grateful for the opportunity together to celebrate our extraordinary teachers during the celebration i appreciated all the teachers have done and continue to do over these last two years since we closed usd schools pivoted to distance learning literally drawing a new map for how school would look and how it would work even today teachers shared vignettes that made me cry laugh smile gave me goosebumps and sometimes i felt all these things at the same time hearing their stories our focus was and remains on teaching and learning for 43 000 students and partnering every day with our families our community to do
024the extraordinary work for our young people as we move closer [Music] and closer to the end of the year i want to remind all of us our partnership and our commitment to do this work together with grace and respect and a constant focus on our unwavering commitment to the excess of every students students that is our focus the next few months are going to be amazing and i'm already looking forward to and planning for the best opening of school yes next fall on a final note i want to welcome first robert presby our newly appointed chief of human resource services and he's in our audience this evening if i can just recognize you dr presley [Applause] and i also want to congratulate our own paul weir congratulations on our activities list tonight he will be
025affirmed as our cca executive director congrats and he is also in our audience tonight [Applause] i look forward to our upcoming classified staff celebrations and appreciations and that concludes my report thank you trustee castillanos thank you [Music] i've done a lot of reflecting in the past few weeks as i've been saddened about trustee bronstein's resignation and the events that led her to that decision although we all bring different perspectives and opinions to the boardroom as adults we know we must take we must make compromises and have respect for one another we all have a common goal here we are here because we want the best for our students our communities as well as our boardroom should be a safe place for all whether we agree or disagree it should always be done with respect for
026one another let's focus on what we were elected to do student achievement and success preparing our students to think critically and globally focusing on supports for them to be prepared and succeed giving them tools to handle not only their academic needs but also their social emotional needs as well we are here to support our families our students and all of our school sites let's focus on speaking to each other with kindness and respect let's agree to disagree and find common ground and work together to bring success for all our students when we work together from the boardroom to the classroom then success will happen let's focus on instruction and best practices adopting new curriculum and novels that represent different abilities and cultures and beliefs let's move our students forward identifying their needs creating a plan
027and working together to create lifelong learners let's focus on educational leaders allow them to lead and trust their knowledge and insight believe in our public schools know they are working harder than ever to meet the challenges of today to educate our students to lead us into tomorrow let's focus on mental health and getting our students adjusted back to school they are living through a pandemic and let's allow them some grace and time to adjust acknowledge the challenges but engage with them that they are strong and can persevere so tonight i would like to take a moment to spotlight and a shout out to one of our amazing schools in aliso oak grove elementary i have a volunteer i'd like to speak about tonight this amazing volunteer works tirelessly for our students he has an amazing
028ability to connect with staff and students he greets students every morning with excitement and thrilled to see everyone he visits classrooms on a regular basis and loves to play on the playground he is an amazing listener and always has time for everyone he loves everyone and wags his tail with excitement as he greets you in the office if you haven't already figured it out his picture is on the screen i'm speaking about the one and only trinidad at oak grove he brings calmness to stressful situations he knows how to comfort and the kiddos are lucky to have such an amazing dog at their school please check out i believe cosd insider is doing an article on trinidad so you can read more about him and his amazingness at oak world i'd also like to say
029uh do a special thank you to miss monsay the office manager oak grove who brought trinidad to our site so thank you trinidad for all you do for our students in capital yes i think once everybody sees trinidad every school is going to want to trinidad so cute um i have three things to bring to the attention of those attending and those listening and i'm so happy that tesoro is here tonight our titans because um the counselor jamie runyon had sent me notification that tesoro high school has now been recognized on the ace sca ramp which is a model program by the american school counselor association so congratulations [Applause] um a second topic is i had the privilege um in my community of mission viejo to be a counselor for boy scouts for community service
030and i had two young men eighth graders sean mcgregor from new heart and maxwell porter from ladera ranch middle school approached me to talk about a topic and this is a requirement to get the community service merit badge and the topic they wanted to talk about was the safety of e-bikes so i spoke to the boys there are these eighth graders about to go into high school um and so they had some i think excellent ideas the next day after they had left in the city of mission viejo there's this little publication called mission viejo reporter and lo and behold the article was why electric bikes are more dangerous than motorcycles um the hidden dangers of riding e-bikes and it happened to be one of the topics i had shared one of the thoughts that
031i had shared with the boys um was that that's something that we should probably train the students about is um when you think about the message on here uh when we think of a motorcycle we think heck no i'll never do that but in reality electric bikes are much more dangerous and so i am hoping that our schools um we certainly see the increase of electric bikes and the needs for the alexa fight um wraps thank you that we're working on um but hopefully maybe there's some programs we can do on the safety and working with the kids um i was at the san juan hills high school for their multicultural event a few weeks ago and had the opportunity to talk to the principal as i saw on the e-bikes and he says yeah
032you know skateboards one time and then it's the razors well now it's the e-bikes so we need to talk to the kids about the stables uh and my last comment was just want to give a shout out i mean we have our different school foundations and ptas that are always giving fundraising to give to our schools this is a a company that we've mentioned before but again jumped off the page of donations for this month is specific life foundation they gave just in the month of march or the 30-day period 79 um they gave 33 000 to nine of our elementary schools fourteen thousand to four of our middle schools and thirty two thousand five hundred dollars to the six high schools and so they are just a tremendous support to us um and i
033just want to give the shout outs as a thank you for anybody listening that's the end of my comments this evening thank you trustee davis give me comments um trustee castillonos um with all that's been going on i've been reminded of this quote by one of my favorite motivational speakers perhaps the greatest charity comes when we're kind to one another when we don't judge or categorize someone else when we simply give each other the benefit of the doubt or remain quiet none of us need one more person bashing or pointing out where we have failed or fallen short most of us are already well aware of the areas in which we are weak we need to support and uplift each other now more than ever we need to remember that disagreements over policies are not
034an attack on you or your identity if you speak publicly you open your ideas to criticism which is part of the fabric of our society of the first amendment and free speech we need to re be respectful in how we disagree but the presentation of different ideas is what will help us choose what is best for the students in this district i am hopeful moving forward we can unite to do what is best for the students with respect grace and love in calcustronomy unified school district thank you mr so at the last um board meeting on march 2nd your csd board passed a resolution in opposition to sb 871 which is senator pan's bill to make coven 19 vaccinations mandatory for k-12 with no personal belief exemption for private charter and public school students this
035resolution passed by a six to one vote which means cusd will be listed on the bill as opponents furthermore on this resolution your board empowered the cusd superintendent or board president to communicate your district's opposition to the bill this step is unprecedented in cusd to the best of my knowledge and it means that superintendent mattal or president mcnicholas may speak directly to legislators legislators about the negative effect we believe this bill's passage will have our position is not anti-vax or even anti-covax our concern is strictly for the bill's effect on in-person education of children and california's entire k-12 educational infrastructure i am very proud of your words rewards work on this issue and i hope you're all proud as well as i said in the last board meeting we all see you and we all
036hear you but what's more some of us remember being you we remember i remember coming to board meetings to express our anger or disappointment over a board matter i want you to know that i'm honored that people care enough about education in cusd to come and speak to us and i really mean that sure the comments get a little heated up sometimes but that's okay our children are our most precious resource so it's natural if people get a little intense when their kids are in concern i'm honored even when the words are somewhat acrimonious and i completely understand when emotions get somewhat raw but here's what i'm not honored by i'm not honored when audience members boo a board member or other speaker they disagree with i'm not at all honored when the student advisor
037is born is booed and it's beyond my understanding that parents would boo another person's child i was also not honored recently to read an email sent to another board member with a subject line you are a hag nor am i honored to see that an individual interested in being appointed to the open seat on your board posted on social media that they were organizing a massive email campaign to embarrass the board into appointing them really the people with whom they say they want to work as though this were a reality tv show or cage match or something i don't know precisely what happened to former trustee bronstein or what that that what how she experienced the harassment that took place so i'm not going to discuss that i'll talk instead about the harassment that's happened
038to me as a trustee i want to be clear i'm not looking for sympathy this is just letting everyone know what does happen because i think the public should know i've had to report extremely inappropriate emails three times there are different legal standards for what's considered a threat to a private person versus an elected official and what happened to me is what i'll call threatening but these instances didn't rise to the legal level of threat because i'm an elected official so it happened if it happened to you it would be a threat but since it happened to me it's not one of the threatening emails came from someone who doesn't even live in our district and who i've learned regularly harasses and threatens elected officials in other parts of the county and by the way
039last week i happened to talk by phone with trustees on two different boards and we got to talking about harassment both of these trustees both men incidentally told me that they have received actual threats meaning that they rose to the legal level of threat even though they are elected officials i've served with these five board members for at least a year as well as five others who've departed each of them has said things or voted in ways that have perplexed or frustrated me and sometimes i've even been angry occasionally really angry but without exception i have found all to be ethical principled people who sit in these seats and spend countless hours other hours on this job because they care deeply about children and their education they've all brought something different to the table and
040that's great i don't expect anyone to dis agree with me all the time and neither should anyone else it's a parent's job and sacred responsibility to stand up for their child it's the job and sacred responsibility of this board your board to make decisions that will provide the best education we can provide for your child and for all children in cusd we are honestly and sincerely trying to do that and no one whether board member teacher principal parent or anyone else deserves to be called names or booed or harassed or threatened for it interesting jones um my only comment and it's it's more of an advertisement um for a and there are flyers on the back uh miguel hill's ptsa and the community of looking indigo is sponsoring a parent and community community education event
041on stock bullying now it's intended to be focused on elementary middle and high school kids we have a number of our principals we have the sheriff's department we have our own student services department our own counselors there but i also want to make this make sure that parents and other adults attend this too because there are there is bullying going on with adults as well please join us on march 21st okay we are all we are on to oral communications oh i'm sorry student advisor patient thank you um good evening i would like to make a clarification regarding the concern um around life changes in high school graduation roles the asb presidents from each of our high schools and i are planning on changing the color of robes to one color to create less of
042a division between the graduating class and then we'll start with the class of 2025 which is our current freshman class we have talked to the asb presidents from the freshman class and they are all in agreement with us graduating high school is a big accomplishment and i believe that having different colored robes based on achievement levels can make others feel unaccomplished and unimportant compared to others it's a very visual indicator as to who has the 4.0 gpa and who doesn't i believe that students should be re i however i do believe that students should be rewarded for their hard work through the years therefore rather than having different colored robes we're planning on giving out medals cords and stoles to wear with their graduation attire as a representation for their accomplishments i understand that some
043of the some students from our high schools um they don't they don't like the change that is going to be done and they believe that it's undermining their accomplishments um through those four years however i think that we should all take into account that there are around 600 other students who have earned to be a part of the graduation ceremony and we should all be considerate and we should celebrate every student thank you [Applause] now we are on to oral communications this is for non-agenda items just a note if you are because we are considering uh later on on the agenda the uh procedure for filling a vacancy if you are here to speak in in support of or against a particular candidate this is not the forum to do enough that is not on
044the agenda that would be on oral communication just a clarification for time for oral communication shall be 20 minutes individual presentations are limited to three minutes per individual but could be less if there are a large number of speakers mrs hayes how many speakers do we have on oral communications we have 10. trustees what's your pleasure do we want to stick with the three minutes two minutes that would give us our 20 minutes on oral communications two judy you want three no 20 minutes um trustees what's your any other suggestions i think we have a very packed a meeting and there might be other speakers later on i would like to i think two minutes would be fabulous we had to hear everyone and if there is for some reason overflow perhaps we could uh
045entertain that later but to keep to the 20 minutes right now for the oral communications non-agendized items so that we can get to potentially other items here in this very packed uh board meeting okay two minutes okay i'm pulling the board uh trusty castile is two or three christy jones advisor claudia justin bullockus bestie davis three jesse hammacher too okay it passes four two we're going to go with two minutes um it says i'll ask you to monitor and help the speakers i'm just as a reminder if they're stupid speakers we let them go first so for oral communications we have shown no student speaker so if you're a student speaker and you filled out a blue card and didn't check that please raise your hand okay seeing none we'll move on with our oral
046communication speakers on zoom we start there first thank you we'll do our in-house speakers leanne williams is our first speaker hello as we move into our new chapter of cusd history one without mask and sadly without former trustee braunstein let us move forward with civility let us commit to speak our minds yes but also speaking with love i promise to look at your child as the treasure but i ask you to do the same for mine just as we do in the classroom let's set expectations for the board meetings we will listen when others are speaking and we will speak with respect for our leaders and for each other let us show respect for professionals in our district these folks have worked their entire professional careers to understand pedagogy theories to master classroom management and
047curriculum implementation to build relationships with students and understand child development so when it comes to the matter of education let's defer to them we can have input as families but let us treat these faculty members as what they are experts in their fields as john f kennedy once said so let us begin anew remembering on both sides that civility is not a sign of weakness and sincerity is always subject to proof thank you very much speaker is katie good evening i had a different speech prepared but instead i would just like to echo what leanne williams just said thank you our next speaker is michelle colossal campbell good evening superintendent board of trustees we continue to celebrate women's history month in march in 2022 the pta turned 125 years old and is the oldest child
048advocacy group in the us and the world the pta exists because of the work of alice maclan bernie phoebe apperson hearst and selena sloan butler today the pta continues the work of these founding ladies to continue to quote the work on behalf of all mankind and women kind regardless of race color and or condition to recognize that the republic's greatest work is to save the children end quote pta takes positions and advocates for children a current project is to support raising base funding in the local control funding formula so schools have the needed funds to provide a robust education please join your local pta and join us in our advocacy work thank you very much our next speaker is michelle mcnutt hi are you able to hear me good evening um i also had a
049different uh speech planned for this evening uh i would like to say that i do agree with leanne as well i think she said that beautifully but i specifically want to thank trustees hanuck and castiano's for their professionalism and dedication to our students through this pandemic i especially want to thank trustee castianos for pointing out the sadness that many of us feel um about losing our trustee in area two which is where i am from uh all of you all uh trustee hannicek castianos and bronstein have maintained integrity even while being verbally attacked harassed and threatened by a small group of loud and willfully ignorant parents the same group of parents who believe trustee castiano's out of her seat um i i'm glad that i heard some of you speak against what's been happening against
050the hostility and i'm hoping that we can all take a turn in a positive direction um lastly i just want to say lisa davis i think that you are dangerous you've demonstrated that you care more about riling up your belligerent supporters than you do about students health and safety all of your resolutions have been meant to inflame not unify and while your marvin ashton quote tonight seems nice let's remember that deeds speak louder than words thank you we'll now go to the speakers in the room i'm going to call um the remainder of the speaker so that you could line up in this order susan saucedo greg young jessica guyer susanna sariamento neil and nora please come forward susan come on up to the mic susan go ahead and just remember to stay like a
051hands lead the way and then we won't get distortion thank you so much hi my name is susan i'm here because i want to talk about peace not the you want a piece of me type of piece but the friendlier more constructive p-e-a-c-e today the world watched as the president of ukraine said that being the leader of the world means to be the leader of peace peace is a concept of societal harmony in the absence of hostility over the past year there has been no shortage of hostility or fear in this room in other words there has been very little peace and a lot of you want a piece of me all of you sitting here are leaders in your own way you lead by example your role models you when you win elections my
052trustee pamela branstein who is an attorney a businesswoman and a parent was also a leader here and won an election her resignation came because her peace was disrupted by individuals who harassed her and by proposed resolutions that were unlawful i'm hopeful that you can all work together to make sure this type of harassment and unlawful resolutions that led to a board member resigning do not happen again i'm here to ask you to be a leader in peace it requires that you are vigilant proactive and intentional in your actions sometimes it's a lot of work like when you collectively work to create peace around the topic of cultural proficiency after misinformation was cleared up i think many parents were like okay let's move on to another issue i urge you to approach your decisions in such
053a manner that will promote peace appointing someone to fill the vacant board seat will create division and many voices such as mine will be left out of the process and i live in area trustee 2 and i am a voter do not appoint instead i urge you to follow the democratic process and let the voters decide i'm a mother of three a physician a soccer mom and i'm here because i want to create a better future for a family i'm hopeful that you feel the same for our children and that you're a leader of peace in this world that already has too much division and war thank you thank you great go ahead thank you president nicholas superintendent royalty trustees civility so we just lost a trustee due to lack of it bullied and harassed
054trustee bronstein resigned now i don't allow for bullying in my classroom and i certainly do not reward it ironically many of the same people who claimed that their children were being masked bullied by their caring teachers those same people bullied and harassed trustee bolt bronstein now as trustees you do represent more people than just that vocal minority of anti-mass protesters most of us voters have been very pleased that cusd has continually followed the state's public health guidelines as have as have all other public and private i looked private schools do it too follow the county guidelines democratic institutions cannot send a message of bullies get to choose who to replace a bullied elected official with i want to thank you trustees for what you do trustee jones for your sentiments tonight many of us teachers
055have also received emails like that and i haven't asked my colleagues to not respond to them it's just ridiculous and i also want to thank our teachers and are classified for their compassion and dedication to all of our students and families thanks jessica speaker trustees superintendent vital realty student advisor patia i just wanted to give you an update on raise the base um first a big thank you to our superintendent who has sent out letters to every superintendent in the entire state um talking about raise the base it is spreading like wildfire people think we have a ballot initiative right now and that is a good thing kind of um as long as they know it's no taxation it's about allocation which we're going to try and make sure they know and thank you trustee
056mcnicholas for get for sharing the buttons with csba during your alleged action meeting this week um and i thank you to see cua and csa c c s e a thank you for your collaboration as well um like i said it's spreading up and down the state um like wildfire and it started right here in capistrano so um the cuc ptsa legislation advocacy team um and our our raise the base initiative leader uh luca we've started a one million letter to legislators campaign um to advocate for the governor to raise the base grant for the local control funding formula by nine billion dollars again no taxation allocation allocate some of that 45 billion dollar surplus you have into the base grant for our students i received an email yesterday educating cusd families about vaccine mandates
057and i would like to ask the board to consider sending info to families about ab1614 um by marasucci and that will support the work that we've been doing for the last couple years here in our district um and also attach the cuc ptsa link so that fam all of our families have access to those letters to legislators so we can make our 1 million mark thank you very much for all your support i've raised the base speaker so you can go in order to susana sorry and then ben neil and then nora thank you good evening cusd trustees and uh superintendent dr christian detel cruelty my name is susanna sarmiento i am here as a concerned educator cusd parent of three and resident of area two first i'd like to echo and stand behind every
058word trustee christa castellanos shared your statement should be shared far and wide to restore faith in the important work you are all here to do pamela bronstein was elected and she was overwhelmingly chosen over jim murdon as our trustee earning 56 of the vote regrettably and understandably she resigned after enduring endless harassment and yes threats all while trying to uphold the law and education code keeping our school district and children safe the madness and lack of civility that has ensued inside this boardroom is deeply alarming i know i speak on behalf of many if not the majority of cusd parents that work and care a great deal for this community and all communities we are the educators therapists clinicians scientists public servants church leaders business owners that may not have the time to show up
059at these board meetings to outnumber the dishonorable mobs that have been distracting you from your agendas and from getting real work done during board meetings we read the results watch the replays and follow what political gains some are playing behind closed doors we are informed follow the data respect humanity both the sick and the healthy and understand adolescent psychology i am here to tell you that we are paying attention and have two requests or the following requests number one we expect civility at these board meetings and zero tolerance policy number two we are asking for a fair process where our area two trustee can be elected thank you for your time thank you speaker um neil would you share with us your last name rish neil richie thank you so much there you go thank
060you board um yeah this is hearing all this uh mob and this stuff i that's crazy because i'm i'm guessing you have a few bad apples a few people that decide to to make a big to-do i personally i'm a i'm a parent of three uh two that go to uh this district one that will hopefully go next year um and the the one thing i always go by is you cannot expect your kids to behave in a certain way if you're not willing to do so your yourself you know we have to lead by example and you know i'm against the masks we don't none of us talk about the the downside of mass all we do is talk about the upside we don't talk about what it does to the kids and we
061all know what i'm talking about you know um the vaccine as well i mean it's we have to be civil to one another we can disagree that's okay that's how policy is shaped you know if you look at our history uh disagreements arguments you name it i mean that's been the best policy shaping of our nation that's what has made us so great but we we seem to have come to this this crossroads in our in our entire government where we just we can't agr we can't disagree we can't you know uh uh have a comment any other way we you know people get silence you know how frustrating it is where you have facebook google all these entities that are trying to silence a massive growing group that is just growing daily it's it's
062incredibly frustrating so you know many of the parents out here they they they feel that frustration and unfortunately they take it out in in in negative not so good ways i get incredibly frustrated at times and i have to push it down i have to you know just do it in a very positive way so lisa davis i don't know you know the person on the phone we we love you you are doing a great job and we support everything you're doing so thank you hello um my name is nora croy i am a parent of two two graduates of of capo schools and i have been a teacher in the district for 17 years in various forms a couple things i want to say i want to start with thanking you trustee castianos for
063your comments on our goals as educators completely agree with you two other quick things one as far as the appointment of the trustees i would say let the voters decide um i want to also thank you for your consideration with regard to the recommendations of the imrc and the new adopted texts we're very excited about that as i i teach high school and we're very excited about having a new bunch of diverse voices and perspectives for our students to embrace um the main thing i want to talk about though is the communication about sbh 71 i want to make it very clear that that communication does not speak for me or many many many of us i am a strong supporter of the vaccine mandate without exemptions except for a medical exemption um as you
064all know i'm sure in 2015 california eliminated the religious and personal beliefs vaccines for all the other vaccinations that our kids take after a measles outbreak several measles outbreaks in california particularly in orange county um and so it doesn't make sense to me for this single vaccine when our kids have six others that there is no personal or religious exemption for um we eliminated it and there was no mass exodus out of california schools so the idea that there would be if this one happened is inflammatory i would say to say the least no major religion has a doctrine against it it is proven to be extraordinarily safe and as educators we must always advocate for facts logic expertise and critical thinking and not allow pseudoscience and misinformation to guide our decisions so thank you
065we move on to our consent calendar please note her board policy 93-23 and in accordance with the law the public has a right to comment on any consent item at the request of any member of the board any item on the consent agenda shall be removed and given individual consideration for action as a regular agenda item from each speaker is a lot of five minutes on multiple items or three minutes per item mrs hayes do we have any speaker cards for consent items i'm sorry we have one speaker from the consent calendar um four items a1 a5 a6 and b1 shall i set the timer for five minutes for this um okay this is michelle apostle campbell we have five minutes to address your four items okay so the timer is starting this will be
066fun good evening superintendent of board of trustees pta's have donated 53 439 and nine cents in the last month not including the funds for the gaga ball court with ada approved gate at djs that was oddly left blank it would be great if the amount that djs donated for the gaga ball court could be included i am happy to see in item 1385 the agreement to put water saving toilets at multiple sites within the molten miguel water district schools as california is constantly in drought saving both water and money where we can is vitally important an item 1386 i am glad to see the ford movement in the building of the new two-story classroom building at dana hills high school this building will be a great addition to the campus and i really hope it's
067done so my sons can actually walk inside its doors one day um and lastly on item 13b1 i greatly appreciate the need for the a3g completion grant i have a new incoming freshman next year and it has been very frustrating trying to gather this information so if this grant can provide a single one-page document showing in checkbox form the cusd high school graduation requirements a through g requirements for both the uc system and cal state system that would be fantastic it needs to be widely available to all students on all campuses and not only does it need to be shared with our high schools but it needs to be shared with our middle school families so they can start planning early so all of our students succeed and thrive and we build them for success
068thank you and look i have three minutes and 15 seconds left thank you michelle um trustees do you have any um items you want to pull jesse bulacas no jessie castianos um trustee davis trustee hannity okay which had him um i actually it's probably more i'm not gonna pull them i just have to reiterate there's something that's always bothers me so it'd be under human resources c um and several of the items there i brought this up before i really prefer not to have appointments and we have basically five revised or new job descriptions and some appear to be cost neutral and some are have a cost to them i would rather see this brought out from consent calendar because these positions may seem business as usual but these might affect different parents different relationships
069some are new i'm not going to pull them tonight but i'm pretty pleased i've asked this before but can we please put um appointments like these job descriptions i'd like to see org charts none of us know what's happening um and so i would really prefer to see that i know our hr individual i have to go home sick so i'm not gonna not gonna pull them but if we could possibly and that way we can have a chance to look at is there is there a plan is there data around this are we um what are we doing with this this type of work moving forward so that would just be my comment so again i'm not pulling any i'd like to ask the superintendent to respond to that so job descriptions and um
070are items that go on consent so if the majority of the board would want job descriptions to be a presentation with org charts then i'm happy to do that but it is just a regular business item these are job descriptions for the associate superintendent that i just asked the board to appoint we've been working on this for months and that we flew it in two different ways and want that job description on the books so that was that the second one is a job that was pr approved actually in november so the cost for that job was part of the support to hrs and it's a temporary position through june at this point so again i just respectfully disagree that job descriptions are a regular business item if the board would like to see org
071charts or presentation on um on the structure of this district i'm happy to do that but it will be always my recommendation to put job descriptions as a regular business item um that if i find that i want deeper information then i'll make sure and pull them in the future thank you okay um trustee jones thank you okay okay um i think that amy just i'm thinking when we get the agenda if this is a concern i think we can always ask the superintendent to provide additional information and maybe at that point we agendize it please talk to her talk to me about the agenda okay all right thank you um so with no items pulled i'll entertain a motion to approve the consent calendar motion to accept the consent calendar second okay moved by
072trustee bullock is seconded by trustee castillanos do we need a um roll call or is this just a number it is a roll call vote student advisor claudia hi trustee bullockus i'm christy castillonos aye christie davis aye christie hannancheck hi trustee jones i'm estimate nicholas hi okay we are on to discussion action items this is item 14 a1 instructional materials recommended for adoption secondary english language arts and history social science supplemental novels grades 6 through 12 dr merwin thank you very much president mcnicholas trustee superintendent of the tall cruelty staff presents item 14 a1 instructional materials recommended for adoption secondary english language arts and history social science supplement models grades 6-12 so i will briefly frame the item and then turn it over to assistant superintendent kiera johnson and executive director megavis who are here
073and available to answer questions these novels were brought forward and submitted to the imrc by our former curriculum specialist virginia wright on behalf of english teachers across the district in response to feedback she received from committee work and from department chairs over the past two years in a previous role therefore the process leading to tonight's recommendation follows our new board policy administrative regulations for imrc process because ms reichel was present at the february 1st 2022 imrc meeting to answer questions however that being said we would like to recognize that the individuals who are making the recommendation and not someone who's representing those individuals should be present at the imrc meeting and because the individual may have additional insights to ship for the imrc to consider so please know that dr johnson who is also the
074non-voting chair of the imrc is committed to this practice moving forward to make sure the actual individuals may who are present for the needs so after any discussion and questions let's a staff staff is fully behind these novels and recommends approval and dr johnson can you please continue and take the item here yes thank you dr merwin first i want to thank the vision of the board for allowing me to be part of this panel um it is one of the highlights of my job um to listen to the robust in-depth conversations between your appointees and other members of the committee it really is why i wanted to get in curricular instruction in the first place was to hear these in-depth conversations with that being said i apologize uh for the uh there was an
075error early on that's the corrected version is in the word packet with the votes um i also want to say that all the novels that were put forward were approved by a majority of the imrc um and i also want to thank virginia reichel for shepherding these novels from the old version sorry the former version of the mrc to the new version of irc um and i want to thank all the members for the time that they put in to reading the novels and discussing them and i am here as well with dr earth to take any questions yeah mr page do we have any um blue cards on this item we do have two we have two speakers both are online okay katie crockett good evening uh yes thank you and i'm voting you
076to um i'm sorry i'm encouraging you to vote to include the additional instructional materials recommended for adoption for grades 6 through 12. they have been reviewed and vetted by a committee of secondary teachers and were approved by the imrc each of the books helps to meet goals of the cultural proficiency plan for example the forgotten fire provides a historical account of the prestigo fire and the terrible impact and consequences for that town which is overlooked in the shadow of the much more well-known great chicago fire of which was arguably much less significant like the forgotten fire each of the books proposed will spur discussion and inspire thoughtful questions such as who decides what makes it into history books and therefore what becomes our collective memory and history thank you our next speaker is michelle campbell
077good evening superintendent board of trustees i agree with the comments just made by katie crockett and i want to add my support of the adoption of these novels with the proposed adjustments for grade levels i appreciate and respect the work of our educators and know they will use these novels to enhance their class discussions thank you very much okay thank you time for trustee comments um jesse jones i would like to move the item uh deleting forgotten fire and poet x uh in other words approve everything sad is untrue other words from home and parable of the silver okay do we have a second [Music] motion dies for a lack of second do we have any other comments justin bullockus my concern uh my couple of concerns is the parable of the sower uh my
078mrc representative made a notation that the junior year which there's a lot of writing that goes on is pretty thin in terms of literature modern provocative um because so much of our dystopian novels in our schools is old so there's an understanding that we need to get more of these books but i am not certain that this particular book um is um is good my other uh forgotten fire which i've been reading trustee jones um if it is the horror of war um and we don't have the teacher there to talk about it um we're trying to understand how this fits into the crypto and if the teacher had been there to explain that i think the members would possibly better understand it but i had checked out these two books and when i read
079uh in forgotten fire uh page 60 about a young 12 year old being raped i would you know i'm not proof but i read that and i i just i was uncomfortable reading it i don't get why we have to have that type of book for our literature i mean i understand um that there are things that go on in the world but a 12 year old um with explicits in terms of uh how she was raped is just nothing that i i've been signing for and approves but i also have a question about poet x um if there's a change in votes um it was noted at the meeting that it was a 7-3 vote yet it's here on a revised it was nine eyes and one nose um if the four of the
080absentee members are they able to then come in and give a later vote is that why we have an adjustment and that's my final question so the the initial the there was a typographical error on the initial um submission it wasn't a change in votes and though all the votes were taken live their roll call vote for each of the novels um and in time so i called out each member of my mercy and they voted um i know and then if they were absent they were indicated absent so the change was it was an error on the one with the error on the author's title and it was an error on um clueless poet x that we reported incorrect vote what's in the packet is the correct and if you'll indulge me with one
081more question when you were very specific in rewriting the imrc protocols and all can you tell me um at what point do you not have a meeting if what is the percentage of number of members need to be in attendance to take a vote um just like we need a forum what is your number um because i see four you know had missed it which represents 29 of the group so do you have a limit that you've set exactly yeah that was um trusty vulcas who was outlined in the ministry of regulation which was a quorum which is we've interpreted as 50 plus one right so you have to have that many a majority of the members president even take action trustee thank you um trustee bilic has brought up a lot of questions that
082we actually haven't dived into um i'm i am for passage of all of these books i know that they were chosen intentionally and that they are going to be able to use to augment and to move our children into this rapidly changing world and we need to be remembered that we do discuss sexual assault and consent in our sexual education and when you look at the age group of the students here that is more than appropriate they they are more than aware i i know none of us want any of these words or anything to be in these novels but i would like uh to move adoption to staff recommendation of adoption of these novels for social science supplemental grades of through 12. second okay it's been moved by trustee hanicek second by trustee castiano's
083trustee jones you have to comment yes i would like to say why i asked for forgotten fire and podex to be removed i don't have a problem reading about rape and uh there's a an attempted rape of a boy there are multiple rapes of a girl there is a girl who um is prostituted out and becomes pregnant and essentially dies in childbirth and and frankly you know i'm an adult i read this and and i think it's okay i actually thought this was an amazing book i love it and and i think you should all read it it was an amazing book i sat down and read it in one sitting almost but here's the problem um often when we are looking at something online where there's something controversial we see a trigger warning for
084people who perhaps have been raped or had a rape attempted on them and i know people who have been raped and they get very distressed when they have to hear about it and and and they're forced to relive it um and particularly younger people who for whom you know if it had happened to me it might have been you know 34 years ago but for a young person it might have been last week and i asked the staff about this do we do anything in terms of giving a trigger warning and what do we do about that and they and i forget the exact response but they said they would discuss it at with the uh department chairs and you know council teachers about what to do well that's all very well and good but
085i'm here to tell you some teachers are not going to do that and that's going to happen one time and then a year from now we've got a bunch of new teachers teaching this book i and and young people who have uh endured this kind of violence are probably not willing even to ask or to state that this is something that bothers them and there is no alternative assignment we can give them we can't say okay for this book you know you can go and do this other thing because there are class to discussions i if i had a child or a relative who had been raped and um and i knew that they were going to have to read this book i would be in tears over it i i i'm not bothered by
086the story i thought a wonderful story it was moving to me i think it's an important story i think the armenian genocide is i mean some of you were here when i was first sworn in by an armenian judge here in orange county who is a friend of mine i it's very important but we cannot subject kids who may be triggered by these these instances to having to read these books in their classes i also read poet acts and i read these two because there were significant votes against them um although i had read some of the others um i i love poet x up to the last 30 pages and the last 30 pages this is a young woman who has been abused throughout the book by her mother and a lot of us
087i think can can relate to this and she's there's a lot of kind of bad stuff that happens to her but it's not it's not rape it's not anything like that but in the last few pages of the book she her teacher and her priest learn about the abuse by her mother and the teacher tells her she has to go to her mother and make it right and the priest tells her to go to her mother and make it right well there is this is wrong and and frankly in california law it's illegal for a teacher to do anything other than report this abuse to child protective services i don't ever want a child who has endured some of the things in this book and i related to this book big time endure some of
088the things in this book to think oh i can't tell my teacher because she's going to tell me or he's going to tell me i need to go discuss this with my mom and there's also at the very end of the book everybody kind of got it on everybody's fine abusers don't change and this book implies that her abuser is going to change i loved the book up until then i actually cried while reading this book it was very moving to me but i cannot approve a book that is telling a child that you might your teacher might find out and not do the right thing for you might will not report this to cps but instead send you back to your abuser christy davis thank you um i i agree with everything that both
089trustees that have shared tonight um and i also appreciate dr merwin's words that moving forward we will have the teacher that recommended the book there at the imrc meeting to present my problem with this is that's what we were told last year when i was serving on the imrc that moving forward we would have the teacher there to present my understanding that we did not have the teacher there that recommended any of these books presenting but rather we have virginia who is lovely and amazing and so well read she was representing someone who thought this was a good idea over the last couple of years that's a problem that's a problem when we don't have the actual person that wants to present this book i i had intentions of reading a passage from forgotten fire
090it's horrific i can't read it out loud i can't i tried a few times i can't barely read it let alone read it out loud and again i know i feel a bit of a broken record in this regard but we have to consider age appropriateness of books we must consider age appropriateness we must have the teacher that wants a specific book at a meeting to present it's very different to have a group of teachers there and say oh yes i'll support that oh i want that book too four teachers said yes i want that book too that's very different than someone saying i want forgotten fire because x y and z and this is this and this is this and last time we talked about why we wanted certain books because we need them
091for ap tests and to get them prepared well it's just very different so i i 100 agree with the two novels that should be pulled and i i would second your motion because i think you said the same two i was but i i missed it and i apologize no we have no x right now we have a motion to accept so the the other emotion died for last of a second i have another emotion okay just sharing my my thoughts so okay i don't move approval and those are some of my reasons we need to be conscious of age of rubberiness we must have the teacher there that's our policy then we need to have a teacher there to present it and to share okay student advisor um i just wanted to say that
092i totally agree with trustee jones i mean obviously like they're like with explicit content like i honestly think that it's age appropriate like for forgotten fire for high school students but when it comes to the like you know like when it talks about like rape or like abuse and things like that like there's like a student like we have a student population that have gone through those things and they come to school as like they're safe zone somewhere where they can just like be themselves and they can like forget about like for eight hours they can forget about like what is going on in their life and like having them like be exposed to like these horrors that they might have experienced i feel like it can be very traumatic and it can make someone
093just not feel safe at school so i mean i agree i don't think that we should add forgotten fire and for x to the list of a group bucks amy far you've already had one comment do you have another short one then i'd like the superintendent to respond sure i was actually going to ask for staff maybe to help the board maybe the superintendent is doing the same thing to help us kind of understand how these novels are utilized presented i do agree i don't want to expose children unfortunately they're exposed to so much every day and so that is the bigger conversation of safe places and where do we where students go um so a novel obviously has stimulated a lot of conversation which is an amazing thing so i think i'm kind of
094wondering now um there's so much that students are exposed to and i i get that we may not want to purchase directly a novel that could offer that triggering thing how horrific that we might have so many students that that might be their their path so i guess i'm looking to see how these novels are i was going to talk about procedurally now that we're a board of six um so i want to i'll ask dr merwin and dr johnson to address your question and then i just want a chance to talk about procedurally when you are six trustees thank you trustee hannicek so um these if approved would be added to the list of supplemental novels right which are available to teachers to utilize um and just as far as teachers being present we
095actually had four teachers present at the imrc meeting they spoke some of them spoke to the novels they were not the initial recommending teachers like i said uh mrs reichel has been great shepherding through she had rep she had recommended these in response to feedback from department chairs from other ela teachers and the teachers that were present were able to speak to how they would use them in class or on behalf of other teachers in their departments as always these would not be the first novels that would possibly have a difficult um content in them and i know that our teachers are very well trained to present that and but we would always want to reinforce uh best practices making sure that they're communicating with parents communicating with the students about the content and framing
096novels in such a way that the students feel comfortable addressing the teacher if they have a concern or getting access to resources okay i guess that was going to be my comment um i know trustee davis was worried that the person who originally recommended it wasn't there to defend the reason but as i understand it it's not usually an individual teacher that submits something for to be approved it discussed does go through department chairs and subject matter committees and [Music] kind of group decisions on what novels because you don't really don't want one teacher using one novel another another i mean i mean i know they have individual uh teacher freedom but that's that's how we get novels that come to our our imrc true is that part of how the process works that's correct
097and i um president nicholas but i also want to address um trustee davis's concern and this was a imrc members wrote raises concern as well as wanting a specific teacher um to be there to present and we were in a situation where we're transitioning from a former version of imrc and how these were recommended going forward i made it very clear and my commitment to them is to have a very specific teacher even if it's recommended by a school or a group of teachers that would have one point of contact so that we'd have someone there to present um so i i totally understand your concern that was concerned raised by arms imrc members and my commitment is to make sure that we do that going forward um creating a specific new application process an
098online application that would gather all the information um including the specific teacher so that we have that person and and the other thing we always do on any of our novels whether it's catcher in the rye or a scarlet letter or the kite runner we still rely on our teacher to present that in context and how to present it to the class it's not uh here go read this um that's kind of what we that's what english teachers do right i'm a science person so i don't know how i would do it as an english speaker but that's the way i understand so any any novel whether one's already approved for these still requires the teacher to frame it in their what their expected what the expectations are in that knowledge absolutely that's that's effective
099teaching practice absolutely okay thank you um superintendent so now that there are six trustees right now you have a motion on the table for the recommendation and the second so if in fact that is a 3-3 i'm not saying it will be but if it is a 3-3 um then this then dies none of these books are then accepted so if there are books that are acceptable to the board then or to most of the board i highly encourage you then to make a a substitute motion and then second that substitute motion so that some of the books then would be approved that are acceptable because then it would have to be someone who voted uh no would then say i'd like this to come back so the complication of being a six-member board i
100just want to make sure you all understand what that would be so if it was 3-3 somebody from the there's no prevailing side so either side could bring it back for another vote uh yes or do a substitute motion before we vote right so if you do a substitute if you are feeling that it might be 3-3 then you would do a substitute motion at least on those books then if the only two books which is what i'm hearing are the poetics and forgotten fire you could then um yeah you don't have a way to do it you would have to just do a substitute motion and these two books would be left off what if we were to uh vote on each one individually you could vote on each book individually make a motion
101for this book make a question about that that's another way to do it okay i'm looking for uh either okay so i probably need to remove my motion if you want to yes you want to um well first off i feel all of these books are super important i don't know i can't read your minds so i am worried that it would be a 3-3 so i don't want to jeopardize that in any way shape or form i would like to listen to the student advisor one more time and then i would make a motion to consider these individually um i had a question so i think that you said that house like teachers they received like training about how to like approach if there's like some sort of like triggering content like in a
102novel but i was wondering if like student teachers also get the same training whether student teachers also get the same training so that's a that's a great question so student teachers are just that their student teachers are in the process and so they're always assigned to a mentor teacher but in their own i'm i'm guessing that most of the teacher training programs that is part of that right best instructional practices but they're always paired with a mentor teacher to ensure that those best instructional practices are implemented in that classroom that they're in they always have someone there with them to help avoid any landmines or issues so that's a great question all right thank you so trustee everybody's had their turn to you do you want another turn he had another turn she must be
103throwing her motion to make another motion okay if i can't have one sign go ahead what do you ever comment them well i do my question is from when i was on the imrc before carrie johnson joined us everything that president mcnicholas has stated is not my understanding my understanding is that a teacher brings forward a novel that they would like to have considered um and it's not necessarily some group of teachers got together and said hey let's pick out some books and then the other question that came up when we've had this conversation before is that that particular teacher who came forward with it probably could be very effective in having the right kind of dialogue in the classroom but that doesn't mean all the teachers but once we approve it any of those
104teachers in that grade level that's within that can teach that so could you please clarify when you say you're really someone trains the teachers on these new novels i don't think that that i have that straight thank you that's my last great question so we're always going to utilize best practices when it comes to using implementing any novels in the classroom that have controversial content we can make sure that any of these novels come with that specific direction and also part of it is informing our principles right and our assistant principles to make sure that they're aware of that and i think dr irvis wants to step in as well and in the process of preparing the cultural proficiency adoption of novels we built into the budget time or resources to provide time for teachers
105to develop to develop instructional units for the novels that are being adopted so that will be work done by our ela leaders to prepare resources and units that would go with the novels that are selected okay trustee hannity would you like to make a substitute motion so i guess it should be to consider each item individually and vote on them okay do we need to do a no we don't need to do a first of a motion for each one then do we you are so you're going to make a motion this novel okay and a second then you're going to do the next kick it off okay um so i'd like to make a motion to approve everything sad is untrue by celia c perez second motion by trustee hannick seconded by trustee jones
106uh this is a roll call we can do on paper okay all in favor say aye aye opposed say no passes 6-0 let me just keep going keep going okay i would like to move forgotten fire by adam for adoption all in favor say i i oppose say no no uh it fails or keep going um i'd like to move other words from home by jasmine varga i said no it fails 42. that's four to two sorry i should have said two to four yeah so like i apologize it fails to focus other words from home by jasmine trustee jones all in favor say aye aye all posts say no that's the 6-0 next one parable of the sower by octavia butler second questioned by trustee hanicek second by trustee castiano's all in favor say
107i i i'll post say no passes 6-0 and the last one is poet x by elizabeth motioned by trustee hannah check second by trusted castianos on paper say i i i'll oppose say no no motion fails two to four okay thank you very much anything else we need from us thank you next item is before make a committee on the naming of the school this is mark campbell thank you president nicholas trustees so i just want to clarify one item here it says trustees may form a committee it should say trust and shout forward committee okay uh to name the schools but i would also like to provide a little background before we ask for uh guidance and reward the this is for naming the new k-8 that's being developed for uh planning area three
108uh being built by uh built out by rancho michigan and they have expressed an interest in naming the school after the development as being reindeer and they had also had suggested naming ascension school after the development assessment so with that knowing that the ranch is uh interested in naming the school after the development staff seeks guidance from the board to either form a committee to um to come up with options for the board to consider for naming the school or to waive the board policy for forming a committee and then staff can come back at a later time to request naming the school uh consistent with how it says she was named after the development so it's really up to the board on how we would move forward on this um i guess i have
109a procedural question can we not if if the board so chooses could we not leave the policy and name the school tonight i would recommend waving the policy and having us bring back at a later date the next meeting to make the school okay uh do we have any speaker cards on memphis city we do not okay so trustees we have two choices here i think if we want to uh if you want to consider the recommendation financial admission vehicle company to name the school rienda we would waive the policy and have it brought back at the second one or we have a motion to form a board committee for the naming of school buildings i would make a motion to waive board policy second okay moved by trustee hanicek second by trustee jones um
110all in favor say aye hi all opposed say no okay i didn't hear too many votes there so trustee hey because i'm not ready to vote i have a question oh i'm sorry i'm sorry so we have a motion and a second any discussion please trustee bullets simple question do we know if this word um i looked it up at google nothing said is it just the name of their face three that they name or does it mean anything i believe it means uh rain like the rain on a horse uh maria in spanish [Laughter] good point okay i'm ready to vote i just wanted to know if we knew i'm sorry trustee uh davis did you have a question no i was just considered membranes yeah why didn't you tell her so i'm sorry
111we were i was moving too fast for you there okay so now with are there any other questions on the name okay the motion by uh uh trustee hanoshak second by uh trustee jones to waive our policy and bring it back so we are waiving board policy and we expect that they need to come back on a second probably next month right okay all in favor say aye all opposed say no pass is six zero so we'll bring back the naming on consent because you've waived your policy in the name then will be uh reigning okay okay um item a3 i think i don't know what the meaning of the numbering is i apologize board policy 5131.62 tobacco smoking and vaping this is dr merwin thank you president mcnicholas trustees superintendent to talk royalty staff
112presents this item board policy 5131.62 tobacco smoking and vaping it's a first reading and staff appreciates any feedback that you that you have regarding the revisions and support policy joined by executive director mike beekman as well as assistant superintendent kerry johnson they will assist with questions staff looks forward to your feedback mrs hayes do we have any parts on this item we have one okay online speaker michelle colossal campbell board policy 5131.6 contains needed updates to reflect the growing epidemic of vaping in our schools and society it is appropriate to provide both prevention and intervention programs to reduce and hopefully eliminate student use of these illegal substances thank you for considering these updates thank you michelle trustees any comments i have some comments um on the first page of the policy second to the last
113paragraph um part of this is structural but i would like to read my suggestion and and basically what i'm doing is i'm adding to the word tobacco not accepting money gifts etc from the tobacco industry i'm gonna i'm proposing to make it the tobacco e-cigarette or vaping industries um the people who make vaping devices and e-cigarettes are not actually in the tobacco industry so that would mean it would say no one uh may on behalf of the district so solicit or accept any contributions gifts or monies for schools from the tobacco e-cigarette cigarette or vaping industries including but not limited to donations monies for sponsorships slash scholarships advertising et cetera et cetera i have a couple of just spelling things that i will turn over to mrs hayes um if the board accepts that amendment
114that sounds okay with me but other comments or questions from trustees trustee davis i i guess i can make a motion but that was kind of just my comment um i think it's important to add that okay so jesse jones is that a motion to approve with your correction or with your audition i'm sorry okay wait the first reading let's wait the first reading should we do that okay is there is there any other place i don't know that i noticed that but um if there's something else that fits in that scene we could add that if it's something where we need to ask also i don't need something so maybe i want to look at it for a quick minute well maybe then the thing to do would be to bring it back to
115the next reading the next morning just for it's on the last paragraph too let's do that then let's let me um if staff could find if there's another spot that might fit in the same category and i would prefer we waiting okay then i'm going to pass this on to mrs um okay do we still want uh it's not a waving uh our the second second reading but we're gonna make the are you moving approval with your your additions well on page five of seven there is again the last paragraph from the tobacco that's what i that's what i said yeah that's right so so i'm not trying to put words in your mouth trustee jones but are you moving approval with these editions unless uh it sounds like everybody's okay with those editions so
116let's just take the consensus of the board and and have staff bring back the next one with those changes but it's a motion right it wasn't a second what kind of was that's why i'm asking for a motion in a second are you sure we can't wave the first looks like you've cleaned it up wave the first reading and and go into i think we're unsure as to whether there were other references that i ought to have caught um so all we could make you could make those changes bring it back on consent so we we're happy to do that okay so do we need a motion to do that uh you do not because the second meeting can go on consent given the redline version of the feedback you've given okay 847. okay you
117may find making spots to add that thank you okay we are on to i think age four first reading board policy 6174 education for english learners this is dr merwin again and thank you again president mcnicholas trustee superintendent patel rulesey staff presents i this item board policy education for english learners this is also a first reading and staff appreciates any feedback regarding the proposed division i'm joined this evening by executive director stacey obi and director william mack who will assist with any questions that you may have and then sitting back there thank you so we appreciate your feedback mrs hayes do we have any speakers on the phone we do not the trustees any comments or questions trustee davis i just had two questions um on page 7 of 12 page 595 um why are
118we taking out the local control and accountability plan and just keep it in el capitan feels like we should name it and my second is um what are our current adults on that next paragraph provide an english development literacy training program for parents and guardians and community members how is that currently going and do we have a lot of support and if not maybe we can share out a little more about those opportunities yes we can definitely reinstate the local control and accountability plans so anyone not familiar with that document can understand what that acronym stands for um the karen guardian and community involvement we do have site english learner advisory committees as well as a district english learner advisory committee so we do share the evaluation document each year and partner with them parents
119and teachers and bilingual liaisons who attend those meetings and they provide regular feedback to us on english learning programs thank you i actually thought that it meant that we were teaching english to adults and i wanted to give a little more information about that so thank you and and my comment on the spelling out of cap or local control accountability plan i i only see it used twice so i usually like the first time you use it you spell it out and then subsequent times you can just do lcap because i see it under program evaluation number five yes on h5 that's correct so well it's actually on yeah on on this third paragraph of page five so if it's if it's spelled out there then we should be able to use the acronym on
120further ones so i think you got it right and we just screwed up looking and putting them apart anyway any other questions comments from our trustees i'll bring up the i was a little uh confused about um parent requests for other programs because i thought do parents actually request a different english acquisition program that we don't already offer or is that for uh parent requests for a new um immersion program or a new foreign language program that would that would apply for both for instance if parents were to request a bilingual true bilingual program for bilingual program if it meets the criteria of the parent request and goes through that process as outlined in ar 6174 then we would consider that and equally the same process for new language immersion programs and such was the
121process that was followed when we first established our mandarin regression program okay okay and it would any of those would come back to the board for approval sure correct that ar 6174 explains in detail the process that the district must adhere to when such a request is received from parents yeah i didn't see board approval on that process though that's why i mentioned it that is absolutely there will absolutely commitment it comes to awards for people thank you okay um any other questions or comments or i will entertain a motion removed i mean to wait the first reason okay i'm going to wait the first reading okay moved by trustee davis seconded by trustee bolacus all in favor say aye aye all posts say no passes 6-0 thank you thank you we are on to
122item a5 resolution 2122-44 resolution of the board of trustees of the capital united by school district authorizing issuance sale and delivery of a not to exceed eight million dollar aggregate principal amount of general obligation refund refunding bonds prescribing the terms of sale approving the form and of and authorizing the execution and delivery of certain legal documents and authorizing other related actions thank you president mcnicholas trustees so uh the our school district's financial advisor from time to time evaluates our outstanding bonds in this particular case measure a bonds measure a was a bond measure that passed in 1999 and it's now eligible for refinancing so keith weber is here from government financial strategies to provide the board with the potential for refinancing the bonds right good evening thanks for having me here tonight so as clark
123said just a really brief update on an opportunity for us to replenish some of our debt and save some money for taxpayers so um in terms of an agenda [Music] okay there we go so in terms of an agenda tonight i just really briefly would give a review of measure a and then talk about the refinancing opportunity discuss the process and the results that we went through and then wrap up with some next steps so measure a as clark said was approved within school facilities improvement to circuit number one the boundary map is shown here on the slide it was the school district's boundary excluding the melloroos districts at the time it was approved by 73 of voters to authorize 65 million dollars of bonds for school facilities those bonds were issued in 2000 through
1242002 they were then refinanced in 2012 and so we're asking for your consideration tonight is to refinance them again here this year so this is a graph showing a benchmark interest rate and when the bonds were last refinanced in 2012 the interest rate was about three and a half percent and currently their debts the market has trades down to 2.3 and i say currently but we prepared this about six weeks ago you may have been hearing in the news that interest rates are on the rise along with inflation gas prices and everything else but the good news is that we locked in interest rates back at the beginning of february so with your approval tonight we'll get to move forward with the interest rate from back then instead of today's interest rate um so in
125terms of process we sent an rfp to banks in mid-january and asked them to respond they had about two weeks to do so and the idea was to encourage competition and we got a lot of competition we had nine banks submit proposals to us uh interest rate trades from about one and a half percent to one point seven seven percent um and the top three banks were so close that we then did a deeper dive to better understand the proposal and u.s bank gave us an interest rate of 1.54 which was 0.01 percent higher than city national but they also had less interest costs and so i'm sorry less lender costs and so when you look at the proposals package uh u.s bank had the most savings and so our recommendation tonight is to proceed
126with the proposal from west bank uh it does have the most savings that interest rate is fixed and mocked and uh it doesn't have a prepayment option but the bonds turn out in five years so we don't anticipate paying them off early we'll just pay them on schedule so this would be about two hundred and seventy three thousand dollars in savings for our taxpayers uh it etched out the second place bank by just under a thousand dollars so the competition here was really really close and we see that as big sign um the interest rate on this will get cut from its current rate of four percent down to one point five four and the two hundred seventy three thousand dollars works out to savings about fifty five thousand dollars per year now in deciding
127whether this is enough savings to warrant moving forward we look to best practices and using a metric from best practices of net present value savings the the recommendation is to move forward if it's at least three percent to refinance bonds and on this measure we're at 3.6 and so because we exceed that metric we need best practices to suggest that we move forward and so this will help reduce our tax levies um when measure a was done back in 1999 the projected average tax levy was 14 and 85 cents per hundred thousand assessed valuation uh tax rates have been on the decline the last decade or so currently the tax rate is less than half of that average it's a little over seven dollars and with refinancing it'll get reduced uh even further and so
128the estimates about eight cents which doesn't sound like a large number but you know every bit of savings helps especially in these times when costs are so expensive so tonight you have a resolution before you uh that resolution would authorize is to move forward with the refinancing you also have a stack of financing documents that were asking for your approval and uh which with approval we'll receive it from this bank as our recommendation and the scheduled completion date will happen on may 5th so thank you i'm happy to answer any questions mrs do we have any of the parts of this we have one online speaker michelle colossal campbell okay good evening thank you for working to refinance the remaining bonds on measure a to further reduce the tax burdens on our communities capistrano unified's
129board of trustees have consistently worked to reduce tax liabilities on our communities demonstrating how they can manage funds raised through our school facility bonds to update our schools at the lowest potential costs to our communities the continued transparency in the management of these funds is appreciated and needed thank you for all you do to keep our tax burden low while working to improve our school facilities hopefully this will help pass future facility bonds thank you jesse jones i have a just a quick question and then i'll move approval um we're not a municipality but i think these are considered munis right in the bond market yes that is correct and are communities generally callable i think some balls bonds are not callable and so these are callable without any penalty to anybody right yes correct
130so with this refinancing we're doing now they are callable and there's no penalty callable basically means it's the date on which we can refinance um that date is approaching this year that's why we're bringing this forward to you and there's no penalty associated with with the with refinancing them and exercising the quality okay uh with that i will move approval from resolution number 21 22-44 resolution of the board of trustees of the capstone unified school district authorizing the issuance sale on delivery of not to exceed eight million dollars uh aggregate principal amount of general obligation refunding bonds for spreading the terms of sale proven reform and offers authorizing the execution and delivery of certain legal documents and authorizing other related actions i'll second that and i have a comment um okay most by trustee jones
131second by trustee hannah checking you have a comment yes um i do need to give a shout out to clark hampton and his trusty sidekick keith weber this has been an undertaking that when i first got on the board um and it looks it seems quaint then but that was our battleground was around our cfds you have been amazing uh your transparency portal that you have all produced and philip is back there she's just pat herself on the back as well this is incredible um i have to admit it it kind of hurts me when we gave the money that could be used for schools but back to the taxpayers which we did that's what we committed to so hopefully uh in the future people will understand what we do here how schools are financed
132and they will understand when we do then go back out for a bond what we're asking and what we're talking about so i want to thank you again all of you this is this has been amazing work i have one comment so when does this bond get paid off from 1999 are we waiting until correct yes august 1st 2026 okay all right i can't think for this bomb back in 1999 okay okay um so we have a motion in a second all in favor say aye aye it's a roll call boom oh i'm sorry it's a resolution a student advisor claudia hi steve bulacas aye rusty castianos aye ms t davis aye rusty hannicek aye christie jones aye steve mcnicholas hi casa 6-0 with a professional preferential vote by um item you're following the numbers
133a6 or 14 e6 uh resolution 2021-45 kappa strategy by school district approving grant applications and agreements for california schools healthy air plumbing and efficiency program projects at capistrano valley high school delaware elementary school and kenosha kenosha elementary school this is our campaign thank you president nick nicholas trust me could i ask that we get the president's presentation on this one and the next one together because it's really the same thing just a different sense you took the words out of my mouth i was so items six and seven are both the same resolution but for different schools and this is for the what's referred to as the california schools healthy air plumbing and efficiency program or called cow shape this these both revolutions six and seven are the final step in receiving the funds the
134all the schools eligible for the funding will be receiving the grant funds and it's the focus is on schools that are in economically disadvantaged areas so these both these resolutions are the final step and i'd like to have a shout out to steve madison our energy manager who is very proactive at seeking out this kind of funding that's been doing a great job how do we have any uh speakers on this we do not okay trustee davis no do we have any comments questions from trustees okay okay so trustee davis move approval second by trustee jones jesse castianus these are resolutions and that we're talking about both of these right okay so the resolution so we do need a roll call vote on these for both a6 and a7 right student advisor pattia hi trustee
135volukis hi christy castianos aye trustee davis aye christy hanichik i'm rusty jones trustee mcnicholas hi we are on to item a7 no 8 excuse me uh resolution 2122-47 uh meeting the 2021-2022 second interim fund balances mr president mcnicholas trustees he's part of ab 1200 school districts are required to report their financial uh to provide financial updates throughout the year this is the second interim report on our financial status i'd like to introduce phillip townsend the assistant superintendent for fiscal service mr president thank you sir so this item is a new item that we are presenting because of a new law that will go into effect in 2223 so it actually isn't in effect yet but in 2223 we will be required to adhere to a fund balance for our unrestricted funds which includes funds such
136as gifts site supply teacher development things like that so this item is here to commit funds which we are allowed to do based on this under this new law which restricts them until the board chooses to take action again so we will be introducing this item every time we present a budget to you and we will use this to make sure that we meet the requirements of the input amounts and so right now the only funds we are committing are those funds that we call our locally restricted balances which are for the schools site supplies gifts chromebook refresh monies and things like that at any point the board can choose to restrict more money for different purposes such as any new board goals that we have so that we can continue to meet the 10
137balance and yet still keep money for four priorities of the board thank you mrs do you have any comment speakers on this we do not okay uh trustees justin dolphus um i have just one question on the uh eight million dollar amount on the last page everything is self-explanatory except i just wonder the one-time uh discretionary which represents about uh 16 of the total do we have a thought as to what that might be or is it just setting that particular amount aside for that category again everything else seems self-explanatory but one-time discretionary i just wondered if there is a plan of how that's going to be spent oh the one-time discretionary monies are the leftover one-time funds that we've received over the past few years and those are being used for textbooks okay thank
138you the line item above it all also is that the division discretionary up those two are used for textbooks no the division discretionary is um the money that the ed division has reserved their priorities so we used to have categorical monies that were at division discretionary when those categoricals went away the same amount of money was put into a division account for things like certain staff members at sites that they want to fund um um sometimes they buy textbooks out of it sometimes they provide extra uh support to schools for extra sections things like that dr merwin or dr johnson verify that a little bit be a division discretion agent yeah we can we can share with trustees a more detailed explanation of what comes out of that fund i'm not sure exactly without looking
139at what you can we're talking about just okay but we'd be happy to share more detailed information on that so so when you mention extra session on the section does that mean that disease yes it's in lieu of the old categorical categorical accounts such as the sip account the eia account all the old categoricals all got when the categoricals went away back in 2013 that money was instead became unrestricted but it was still set aside to pay for the priorities that the divisions already established at the school sites and if i could add two so by extra sections would be like adding additional classes additional intervention classes lowering class size by having more sections provided to the schools thank you there was a time in which it picked up an extra avid class i remember
140i'm not sure that it does now but it did maybe two years ago so we can provide that detail any other comments questions i'll entertain a motion i move to accept resolution number 2122-47 community 2021 2021-2022 second interim fund balances a uh motion by trustee bullock is second by trustee davis to some resolution so it's a roll call student advisor claudia i'm trustee bullock's aye steve castiano's hi i'm rusty davis aye trustee hanicek aye rusty jones aye ms steammick weekless hi uh moving on to item 29 or 13.99 remembering you're following this is certification of the 2021-2022 second interim report marquette park hampton thank you president nicholas trustees this is the actual second inner report it's required by av 1200 and philippe townsend is here to present this item as well thank you okay i'm
141gonna start so this second interim report revises the report that you received in december the first interim report and improvises it for any changes that have happened since december the biggest change that we have seen is the revision for the new salary settlements that were approved in early march only the part of the salary settlements that are not contingent on new revenues are included in this budget the rest of the salary increases will be included once we include the new revenues as we just discussed the reserve cap does come into effect next year and there are some rules of about two is exempt from this rule so basically districts and small school districts are exempt 10 percent of the assigned and undecided ending fund balances is the cap of what you can have in your
142reserve account these include our locally restricted balances districts can request a waiver from the county office but the county office is not really enthusiastic about granting those waivers so that beliefs are our only option is to commit funds or to spend all the money which obviously would have to be done in a not so global way so it's better to have the funds committed than to try and spend down to ten percent before i start i did want to say that the criteria is standard in the second infirm report starting on page 91 of the report are the criteria and standards which are used to evaluate school districts fiscal solvency and both are the orange county department of education and the california department of education do look at those criteria and standard standards um basically
143they're questions that we have to answer we either meet a criteria or we don't and if we don't we have to say why we don't need it some of these criteria are imposed by the state when they change their budget so one of the criteria that we did not meet this year was on page where we had a variance in our budget where our anticipated lcf amount in 2223 was a lot greater than we said it would be at first interim and the reason for that is because the state proposed a much higher cola than we expected at first interim so we were out of compliance because the state made us out of compliance so we just have to explain all of those as to what our reasons are and this is very similar to
144what we do when we speak to the orange county department of ed so once you approve this report it goes to the department of bed they then look at it and then they call us and they ask us a lot of questions so this is very similar to that and if they're satisfied our report just goes to cde and everything's fine if it's not if they're not satisfied then we have to explain in more detail what they're concerned about so um we are required to certify our financial report twice a year and so this report is a positive certification so when we do our report we are required to send the department of bed are assumptions that we have made when we're doing the report so on the left you'll see there are the assumptions
145we made for first interim and on the right is the assumptions for the second input as you can see the changes are mostly that cola rates have increased in that second interim and also we have um the salary increase at the second interim and then finally at the bottom you'll see the the expenditure timeline for the covet grants at the first intern we were expecting to spend all the money over two years because we had some savings on what we had proposed to do we are now able to make those funds last for three years so that allows us to do class size reduction for one more year this is a graph just to show where we're at with enrollment this ends in 2122 but if i had another year in there you would see
146that we expect to define another 800 students next year hopefully we're wrong that it's going to be better but right now we're expecting 800 fewer students next year this is what we showed you at first interim as to our deficit spending and our ending fund balance as you can see in 22 20. 24 25 we expected to be below two percent although that wasn't one of the years in the in the multi-year projection when we get second interim you can see we've improved since first interim and now we're at two percent in that fourth year will become part of the multi-year projection in june so in the future we will be bringing back a budget in may which will be the preliminary adopted budget for 22-23 and we will also present the estimated actuals um
147along with the final 2223 budget in june now i guess we will be presenting our 21 22 and audited actuals which is a little early but that's just the timing how it works this year so self recommends a positive certification of the second interim financial report says do we have any blue cards on this we do not uh trustees questions or comments i think i have a couple of questions so i uh often go over to the criterion standards review summary which i consider to be sort of a cheat sheet and some of these i think you know you never really know whether it's good to be met or good to be not met so you have to read each one um so there's a few of them that i am interested in knowing more
148about one of them is number eight deficit spending unrestricted deficit spending if any has not exceeded the standard in any of the current two subsequent or two subsequent fiscal years and we have not met on that can you speak to that a little bit yes so um the way the calculation works it looks back for the three-part years to see what your average level of deficit spending is and then it projects that and says are you outside of that that calculation and usually we would be because you try to be a little bit more conservative and so you end up doing slightly better than you expected to do so our deficit spending wasn't quite as much as we're projecting in the future so the future always looks a little worse in the past so we're
149outside of that range of um fluctuation that we had in the past okay but it sounds like in this case it was good to be outside of the room right okay um and then uh if applicable changes number seven changes occurring since the first interim meet the required contribution to the ongoing and major maintenance account i.e restricted maintenance account and that was also not met there are two criteria for the routine repair and general maintenance camp one is that you have to contribute three percent and i know sometimes our budget is slightly under that but we always meet it at the end of the year when our actuals come in um the only other one we have for routine repair is the contribution how much you contribute from the gener from the unrestricted general fund
150into the routine repair and general maintenance account um that could have been more than in prior years because we're spending more okay okay thank you just use any other questions or comments i'll entertain a motion to approve the certification so moved who by trustee hannity second by trustee jones uh this is the voice vote since it's the second interim financial report i believe it's a roll call call okay student advisor patia i davis trustee hanicek i'm christy jones hi steve mcnicholas hi okay we are on to uh item a10 or 13 e10 trustee appointment process trustee vacancy and trustee area 2. uh superintendent natal royalty will you present this one great yes opening of the presentation um tonight i do believe after my presentation there are 28 speaker cards um we have provided in the
151presentation their proposed timeline of potential board actions and so either the board can take action tonight for a provisional appointment or you can take an action to order an election so march 16th um it will take four of uh six of you in order to make one of these actions yeah there should be a presentation i'm going to keep going while they bring the presentation up um [Music] in you don't need to wait okay um so if you were to take action for a provisional appointment we would open our website to accept applications we've done this before we have an application we have draft questions we would then create a special board meeting february excuse me april 13th to then um be able to vet those candidates we would then have a deadline for accepting
152these applications legal would then have to vet these applications to make sure that the person applying lived in the boundary and so we've been asked many times which boundary is it it is the old uh area two boundary not the new um it would be completing that term and so this term would be a two-year term not a four-year term we would then at that special meeting can conduct public interviews of those candidates and then we would appoint on that evening so that's one decision that the board could make or tonight you could vote to put an election on the ballot and so we have been advised both by legal counsel and by election code and oc registered voters that that election would take place november 8 2022. so if you were to then get
153to april 13th and you then still have two potential actions each time we would put both items on the agenda you could either interview and appoint a trustee or that night you could order an election and again we have mapped out potential timelines for applications and how that will work we also have built into the timeline if that night you don't find the right candidate then we would open up the application process again we would take applications that the applications and have yet one more special meeting to be able to make that appointment if that's the way the board would want to go um so if the board doesn't take action tonight you can still take action on april 13th i'm on slide four um or if you do not take any action either to
154appoint or call for an election by may 2nd then the county superintendent of schools would call for an election to fill the vacancy and again that would be the november 8th election so i'm going to take just a minute to talk a little bit about on slide 5 the process to interview this a process we've used before the board could craft a different interview process but what we've done in the past is we've taken blue cards we have done a hat draw to determine the order of interviews and then each candidate is called to the podium they give a brief statement and they give they are given one to three minutes and then the board in ron robin fashion ask questions so you can start with two questions and then you would ask those questions
155consecutively and then you can pass or continue to ask questions each candidate in the past has been given 20 to 30 minutes so after you go through this process the selection process um on april 13th would be each again the community would be able to pull a blue card and the president would call for nomination of candidates after that the president would recognize each trustee who which wishes to nominate a candidate and then once the nomination is made the president would call for a second on the nomination the nomination is seconded it's successful and then and if it's not seconded then it's not successful and then you would repeat this process until you were able to announce the pool of nominations and then after that let's say there are a number of nominations then as
156soon as the board president would pick the first person and then you'd vote on the first person the second person until you have a final appointment with at least four votes let's say that night you don't find an appropriate person then we've built into the calendar to either return to the agendaized item and make another special meeting and more open up the application process to be able to have more interviews on another night or you could call a special election on that night um and then um i think the other issue is when you're talking about a six-member board if you are dead locked um then those you can either call for a special meeting you can again open up for more candidates you can then call another special meeting or you can vote for
157a special election so we've included our board policy i've been asked what if we wanted to just have a special meeting waive our policy not have an interview process and appoint someone that is the board's purview to waive your policy and appoint someone without having that interview process so the purpose of this particular item is just to share with the board information about here are your options and then the subsequent items there is not a presentation the board will either take action on doing the appointment process or take action on putting um in a special election or directing me that you'd not want to do those two things or either one of those things tonight and you want me to do it on april 13th you just have to keep in mind by may 2nd
158you need to either call for an election or an appointment and we do have janet mueller on our zoom call tonight if there are specific questions that the board has about the process that in candidates or anything else it is my recommendation for this board to call an election i do think it's important that at this point with our focus for the next three months as i said in my opening comments is to really focus on teaching and learning to really focus on the well-being of students um and to do that work and really close out the year well and i think an election process would be the best way to do that but again it's the board's decision and i leave that up to you hey trustees we do normally do the presentation and
159then we hear all uh speakers and then our comments this reminds me of that uh mrs hades do we have how many speakers do we have we have 21 in-house speakers and we have seven speakers online trustees what is your pleasure do you want to hear everybody at three minutes everybody at two minutes everybody at one minute i'll entertain suggestions or promotion i'm going to suggest one minute for a maximum of how many testicles do we have 28 28 for a maximum of 30 minutes okay if that's agreeable to the rest of the board one minute so we could hear all speakers i would like at least two minutes okay i'm gonna pull the board one minute or two minutes trustee castiano's jesse jones well i would go with a minute and a half but
160still limited 30 minutes i mean you know i mean i mean whatever i okay two minutes but a maximum of 30 minutes right well that would be 60 minutes but our we do not have to give 60 minutes the board policy is three minutes um to maximum 20 minutes we can limit the amount of time per speaker and we can almost look also we can wait board policy to make the number of minutes per speaker smaller and we can make uh or or larger i guess but we can also wait for policy to increase the number of total minutes i'm proposing that we not infinitely increase the number of total minutes that we will increase it to 30 minutes okay okay sorry i just think i would like to give only at least okay i'm
161gonna go back to polling again one minute or two minute trustee castiano's trustee jones comments jesse bullockus trustee davis trustee hannah okay i'd like to ask speakers though um but wait a minute the second question is maximum no i think we're going to go with two however long it takes we did that was not the and we'd ask that ask it like to ask the speakers that if you are just uh repeating what the person in front of you said please make it as brief as possible um we all want to get through this in a reasonable time and but we want to hear everybody and please know that excessive popping or booting or booing or whatever will not be tolerated so please just let us know your input and we will go from there
162we start we do we have any students that we recognize i have no students marked on the cards that were registered online if you are a student please raise your hand i will start with the online speakers and then personal speakers okay katie crockett hello trustees after interviewing the information presented by superintendent vital bruelty and the exhibits for this item i request that you do not appoint to fill anyone to fill the vacancy left by former trustee pamela bernstein given the voters strong endorsement of ms bronstein in the 2020 election i think you should wait to allow the voters to choose her replacement i do not want the very people you who did not want to follow this board's legal counsel's advice or who still refuse to condemn the bullying and inappropriate behavior toward former
163trustee trustee bronstein which precipitated her resignation to appoint her successor even temporarily thank you speaker is shelly blair good evening trustees i would like to begin by first thanking you each one of you for your service to our community and the time and energy you spend supporting our students it's evident to see that you all care about our students and i'm grateful for that as a resident and a parent a ledera mom in area 2 i'm asking you to consider voting for a free and fair election so that every voter in area two has a voice as we know our vote is our voice and that's what we would like to do thank you our next speaker is michelle colossal campbell michelle go ahead if i clicked on mute i'm sorry go ahead good evening
164i encourage the board to vote to hold a special election in november 2022 so the constituents in area 2 are the ones to directly select the replacement for trustee pamela bronstein i know the trustees on this board represent all children in the district so the needs of area 2 will be met through the six sitting trustees it is important that this replacement be held in the most transparent and democratic of ways an election is best transparency is an issue this district has battled and i hope that transparency is what the district board will decide to follow and make sure their decision is fair and just thank you our next online speaker is gary prichard as a former member of the board of trustees i would urge you tonight to support a special election for area
165two so that the voters decide who best represents their interests it seems to me that the trustees and superintendent would agree that a special election fits this particular vacancy when considering the reasons the former trustee resigned as i listened to your meetings over the past year it seems that there were many issues that cut across the usual political boundaries such as health and safety policies curriculum student support services school financing and the specific issues that area too like the planning going on uh in rancho mission viejo where trust seems a bit fragile these days and growth very certain both the manner and brevity of the trustees of excuse me both the manner and brevity of the former trustee would now call on area 2 for their input in an open and fair election process to
166decide who speaks for them thank you for your consideration our next speaker is lisa o'connell i don't have lisa online with us we'll move on to priscilla wong hello good good evening superintendent and trustees i want to voice my opposition to the provisional appointment of any individual particularly those who hold extreme views and oppose our district's efforts to implement our board adopted cultural proficiency plan as parents and voters there must be transparency in the process and a clear pathway to elect our public representatives i also echo the comments of the speakers at the beginning of the open session about the need for civility our board meetings have been a place of chaos and disruption and an appointment will only fuel that chaos miss miss pamela bronstein resigned from the board in part due to the
167quote never-ending organized harassment by a certain vocal minority no one should be subject to such harassment and abuse we teach our children both at school and at home that bullying is not okay and threats of violence are unacceptable yet this board in our community continues to be subjected to the aggressive voices and belligerent acts of a small group of adults who support a certain trustee despite repeated reminders they refuse to model or engage in civil disagreement disagreement what kind of message does this send to our children there is no place for verbal threats and intentional spread of lies and misinformation in a public forum it's no wonder teachers administrators and trustees are leaving at record numbers we must do better civility means we speak and act with respect and civility starts with holding a fair
168and transparent election thank you we will now move to our online speakers i'm going to call five names and ask that you line up i'm sorry did i miss it amy is with us online good evening trustees and superintendent braulty i live in cusd trustee area six and i'm zooming in to speak out against the escalation in harassment and intimidation tactics against public servants and especially those who were duly unfairly elected by the voters our public institutions depend on the willingness of highly qualified and talented citizens to serve in elected and appointed positions we cannot allow the public to threaten the bodies lives and livelihoods of our public servants and their families because they disagree with the viewpoints or policy decisions what took place leading up to trustee bronstein's resignation was completely unacceptable and intimidation
169tactics used by your opponents in board meetings and out of the boardroom this past school year must be denounced i implore you to do what you can to bring civility back within our district between those who disagree we cannot let the loudest or scariest voices decide who serves as our public servants we cannot let ma let mob rule become the norm the election of pamela bronstein was just over overturned by bullies and i wonder who will no longer be willing to serve now and who will still be willing to speak out with controversial viewpoints please let the voters choose trustee bronstein's replacement hopefully the next person will not be intimidated to leave office let's prevent this from happening again let's get back to civil debate peaceful protests and honoring election results our democracy depends on
170it thank you mrs do we have lisa o'connor on the line i called her she was not online and i still i don't see her okay so we go on to in person yes so i'll call five speakers and ask that you line up and we'll do the we'll try to stick to our order kira davis leon patty eastwood amy baxter and paula go ahead hello i'm kira i'm a 13-year ledera ranch mom with two kids who have gone to cusd schools nearly their entire lives today is the two-year anniversary of 15 days to slow the spread and it has been a really stressful 15 days and over the last two years we haven't always felt that our board was listening to us or hearing us and i currently share the concerns of my fellow
171residents and parents that our board seat is empty right now we look forward to an election we want an election we deserve an election and i think listening to everyone in here that it seems like people of all ideologies on both sides of this fence want an election and i love that i think it's like the one thing we seem to all agree on in all of this so i think that the board should take advantage of this very rare moment i agree that an appointment would only cause more angst and disruption this is our seat and we should choose thank you speaker just a note to stay about a hands leg away from the microphone otherwise it distorts hello i'm just a little closer testing testing you're okay my name is leon bueno i
172live in the district for over 25 years and i'm against an appointment and i'm for an election because i want my vote to count thank you reitera reiterating what leon said i'm for an open election and no appointment let the people decide thank you thank you amy baxter thank you um merriam-webster defines trustee as one occupying a position of trust and one to whom something is entrusted it is this concept upon which each of you was elected each of you sitting on the board this evening has earned the trust of the voters through elections processes appointing a trustee without the will of the voters from area 2 flies in the face of the democratic process of which you are all beneficiaries in an email sent to me earlier this week i was told that an
173immediate fix would be short term we want voters to select their own representation however should the board decide to appoint someone in the interim he or she would hold that seat through november seven months away that doesn't seem very short term to me trust is earned not given voters must be allowed to choose their representatives thank you before paula begins i'll call the next five speakers to line up barbara burkowski jamie hansen jamie f nancy and luanne biggs go ahead paul [Music] good evening i am a parent i live in this district the board must take a stand for civility and decorum the job of all board members is to ensure a quality public education preparing students for higher education or another career path voters should decide who fills the seat on the board candidates
174and trustees who harass bully or dox students trustees and other members of the community have no place in education period the board is responsible for protecting each other thereby protecting the students interests i urge the board to leave area 2 seat bacon until a november election and work together to provide quality public education for all students hi i am my name is barbara and i am a resident voter and parent of a child in the district the uncivility and harassment that led to the board vacancy is unacceptable i'd like to thank those trustees that spoke out tonight and publicly denounced such behavior it's important to know where you stand on this issue so that we the voters can vote accordingly in the future harassment is never acceptable this is not a political issue it is
175one of safety our children need to know that they are safe and that you will protect them from all sorts of bullies whether that's here in this room or in their schools i ask that the board leave the position vacant and hold an election so that the voters can decide thank you amy hanson i thank you i would like to reiterate what so many have already said and first thank you to the board um for keeping our kids safe over the last two years i know it's been a really really hard two years for all of us and to leave the vacancy open so that the voters can decide thank you jamie hi my name is jamie and i am a parent and i live in the district and i am here to say two
176things tonight um the unrelenting harassment and bullying that led to pamela's resignation is shameful despicable and a reflection of tactics that continue to be employed by an extreme group this behavior is nothing but deplorable and should not be allowed to go unchecked or uncalled that's how it continues and that's why our world today is doing this people are not standing up and saying that this is not okay number two the vacancy created by pamela's forced resignation for the safety of her family should remain open let the people decide this is the sentiment of the extreme side and it is also our sentiment please let the people decide thank you nancy rohr and following nancy i have luanne biggs as a resident and a parent of cusd alumni students i thank you for your dedication to
177students in education dedication that should never have to include being bullied and harassed please allow voters to choose their trustee in november don't make the school board a destination point for extreme partisanship or used as a stepping stone for future political aspirations of only three potential appointees i've heard about one is aligned with ideas that are at odds with public health another has not only sued the district but also lost the election against pamela brownstein and the third person hasn't had any affiliation with public schools since he was in high school never been to a pta board on a board not a teacher and doesn't have family involved in public schools we need to find people who are neutral and whose track record is has demonstrated passion experience and commitment to public schools but i
178urge you to let voters choose respect their choice thank you i'll call the next five names judy i believe it's campbell judy eva harrison heather and amber smith and karina donahue judy judy's not with us we'll move on eva harrison hi there uh thank you trustee jones for letting us know that the board voted to oppose sb 871 and i think you said it was unanimous it was 6-1 6-1 okay thank you that was that was a very important vote and i'm super excited to hear this now because of what has been happening in california because of the potential mandates under this continued state of emergency i would like to ask you to please have a special election so it you know this empty spot will be filled and we are two will be represented
179here uh please do not wait until november many important decisions will likely have to be made before november and every vote counts um if that's not an option i would be for appointing someone uh someone who's a parent choice someone who is a parent in the district who represents students and parents interests i know our resign trustee as well as a few of the parents here tonight call us the vocal minority even though we've been the vocal majority for at least five months parents who came out for the first time tonight saying they couldn't be here because they're professionals or they own a business or things like that and that's why they don't have time to come here they are actually the vocal minority we're all busy we are attorneys business owners healthcare workers etc
180cetera and this i hate to put us into that mob category because we we haven't been um we've been making time every single board meeting to show up and to speak for our children our own children have spoken here we've been here for five months and we've been the vocal majority um the vocal majority so please i would like you to listen to us and not wait until november uh and hold a special election thank you i feel like i should say my last name because i know you get scared i know i do it is it's scary it's okay it's it's poo heck yeah sorry i'm married into it i love the guy um so i have a lot of thoughts tonight um i am also a mother of three in the district um
181like ava said i work full-time um and i've been here a lot you guys recognize me you are afraid every week to say my last name so that's right yeah um i have a lot of thoughts tonight um i'm not a peacemaker i'm not um that doesn't mean that i would ever threaten someone um i would never advocate that behavior i personally am very loving and i'm very kind um i just happen to really hate having an elephant in the room i would much rather have a difficult and heated conversation that leads to change than have peace um my husband is a peacemaker we actually argue about this a lot because he would rather have the elephant i would rather not it causes some issues um but i love the man and we make a
182really great team we balance each other out even um even though he drives me absolutely crazy um i'm here because my children have struggled so deeply over the past two years um i am educated i work all day i have three children that i juggle and i'm here regularly sometimes raising my voice trying to do so respectfully um advocating for them tonight um i just want to say that the children of the parents deserve to be represented i know a special election costs money um but if that's what it makes to or if that's what it takes to make sure that there's representation representation for area 2 then i think that that's what should happen um if not i think you should appoint someone i think that there should be someone that's representing parents in
183area two um so that's just what i want to say thank you okay i am here to support the board on filling the empty seat until we can hold a special election in november i'd like to voice my opinion on appointing a person or a parent that will support the rights for parents and children to choose what they feel is best for themselves or their children only a parent knows what is best for their child not the government not the schools not the school boards but the parents i fully support parents and students that choose to keep wearing their masks and get vaccinated i also support a parent or student's right to not wear a mask or get vaccinated with an experimental vaccine due to their personal or religious beliefs we live in america the
184land of the free or so we thought the california government and the teachers unions have been using our kids as pawns to push their political agendas and line their pockets i want a board that puts the students needs and best interests first as for the bullying and harassment that is that is are being accused of i have personally never sent an email to any person on this board that has not been respectful nor would i ever tell anybody to do that just i just wanted to let you know now i have been bullied by the pro masters i have a certain mom here that post pictures of myself and my co-workers on her twitter feed all the time my daughter was almost ran over by a pro master she was bullied online she please like
185do do not realize like it's it's not the us that are just these awful people okay it's coming from both both sides unfortunately there's bad apples on each side but there's also a lot of us respectful people too and while they're saying don't bully don't bully don't bully shame on you we had a mom call out lisa davis what exactly was that that once again was the hip hypocrisy of the left before korean speaks i'm going to call the next four speakers jane lee gina young kirsten breska and julie lill hi i'm karina donahue i'm here to just say that we the parents need to be represented at this board by a person that is pro-parent i agree that the school board should hold the special election so it's fair transparent and we pick somebody
186that is the majority that can speak for our kids and for our parents um i wish i could say everything that amber said because she put it in words what i've been feeling i sent emails to every single one of you in a very respectful way i voiced i voiced my disbelief in some votes that you took and i i think for some other votes you guys have taken but i did it in a respectful way she said that there is bad apples in both sides so nobody should be labeled it's a hard time for everybody it's it's something new we don't know how to navigate never thought i would be talking on a school board meeting i hate talking in public but here i am i it's just for the kids and the parents
187that's all we want it's everybody has their own opinion but what is better for the kids you know so just let's hold this special election let's get somebody there and let's put kids first and listen to the parents thank you so much good evening trustees um i just wanted to i mean i'm always every time i come here i'm always talking about the american flag and the constitution and this whole division this anger of course parents are going to be angry because americans are angry if you if any government any person tries to violate our inalienable constitutional rights and especially of our children of course we're going to voice our opinion there is no animosity towards you know any particular person it's it's a matter of our freedom and that's you know and if anyone
188comes to to take that freedom away there's gonna be anger because like my brothers the veterans and the fallen soldiers i always say the same thing we don't want division here we want unity we want to work have trust and respect for our trustees we don't know what happens behind closed doors but if if our children's best interests are being served we're we're we're more than happy to give our 100 support we're the first ones at schools to go to all the fundraisers and recycle this or be involved with our children and our teachers but you know what we've been seeing in the last few years or in the last couple of months has been very disturbing like i mean we're talking about bullying i'm sorry what you went through trustee jones you know that's
189not something that we represent and thank you trustee davis for coming out here and the last time that we were here of course we were angry because we saw our children crying they felt misrepresented they lost trust in like the education system because here they are these young freedom fighters and they're thinking they're doing the the patriotic duty and they were so disappointed and the only trustees that i saw who came out to see how you know the parents were doing the parents were upset they were crying the children were crying it was it was really disheartening thank you jane our next speaker is gina young [Applause] go ahead and come forward a u.s federal judge in texas has denied attempts by the u.s food and drug administration to conceal data on fija's corbin 19
190vaccine the judicial rule overturned the regulatory agencies plan to withhold data for up to 55 years meaning uh 2000 they were going to disclose all the fisa data's and most of the most of us will be dead by then so what what are they hiding is it just what we believe in is just a pseudo-science or we are really a truther and we try to tell the truth physio is funding facebook's fake checking partners do your research and connect all the dots and draw all the control your own conclusions um i believe that most of us here um who supports um anti-met i would say face diaper mandate and vaccine mended we are here not because of just a mask and vaccine we are here because we love our country our god our constitution and
191our children this is really a spiritual warfare um i hear the few people uh express their um frustration in negative ways but they these couple people they don't represent all of us we are here really for the truth because we love our country um we have been very patient for the last two years and our voices has been silenced we have been censored and now we want everyone we want to ask everyone to do the right thing when chinese communist big chinese country they become a communist they all started taking away parents right one by one first period freedom of speech freedom of religion freedom of choice and what will be the next are they gonna take away our parents consent and then they will do uh critical race theory and then what um gender
192change hormone treatment what will be the next people wake up we are going through this great awakening and we are awakening we are waking up if you still believe in those fake media and and brainwashed by this media i want you to wake up now and protect our children and do the right thing thank you our next speaker is hi um i have five kids in the district right now i'm from elementary through high school and i just know that if i am i know i'm a parent i'm not in the open district but i would want representation at eight months that is so far away for them to go without having any if you guys could consider doing a special election so the parents could be able to vote let the parents vote that
193the voters choose not all parents just all the voters choose who they want but if it could be done before then think of everything that is going to happen between now and november it's a lot and it's a lot of decisions being made that parents aren't going to be represented if we don't have the spot filled but i truly believe that it has got to be an election you guys need to become an effective functioning efficient supported board and that is going to happen by having a person selected that the voters choose and sooner than later think of what happened in the last eight months we can't wait another eight months to get another person in there and we can't have other people choosing it needs to be a vote it needs to be done
194correctly and i am behind that all the way i am here to support you guys i'm here to support kindness and following up but i am saying that we need to support what our kids need and we need to have it done now thank you the next speaker is julie little and julie before you start our following julie we have jean and then jim reardon go ahead hi um first of all i want to address and say um unfortunately there are bad apples in every camp and harassment and bullying has absolutely zero um place here in this district um and unfortunately those bad apples stick out really badly and they're the loudest and it's just unacceptable um first so i want to call for a special election please do not leave the seat empty until
195november just like the previous woman said the students in areas who must be represented um eight months is way too long so it will cost money we got a lot of covered money so that's great um and they need to be represented prior to an election in november lastly i would like to add in response to the discussion regarding the graduation gowns i respectfully disagree with your thoughts that it's a good idea to have good idea to have everyone wear the same colored gowns julie um i have to ask you to stay on the agenda item that's part of this some of these other people were not on the agenda item all right it's a bad idea and this isn't little league they're adults i'm sorry thank you julie hi hi board um i appreciate
196your service um i have two grandchildren um our cha our children came up through the capitol district at uh bernice air in san clemente high school two grandchildren that are coming so i'm very concerned you know about what the representation is on the board um like the others i do support a special election to have this have the seat filled i do want to say that uh two weeks ago there are many mothers here who poured out their hearts about their children the abuses they have gone through uh being masked and segregated it was very heart-wrenching and to the parents that were here we felt like our voices weren't heard that's i think that was the that was a sentiment i felt um i am encouraged that you came with a resolution to um send
197up to this to be against the senate bill 871 because the uh i mean all of all of this has been just crazy i think the mass optional would have been a great solution for a long time also vaccine i'm sorry i'm i'm being asked that you stay on the topic of the appointment process can i talk about the gowns no okay april 20th yeah yeah okay all right i just i also asked that you consider somebody um that we consider somebody with that takes the parents concerns um i was listening earlier to these novels that were being presented some of them have some very controversial topics that i wouldn't want my children to to be involved with um do parents get to decide do they have a voice in these novels that's what i
198would ask so i'm promoting a member yes and i'm the last i take it all right i i'd first like to start out with a question um for everyone which is what is the date of a special election if an election is called tonight is there is anybody willing to answer that question we can't respond to the speech okay well i think that it basically falls in november so there's not really a choice in my view between having a special election and letting this go but i do want to make a few comments in eight years of service on this board i've never seen this atmosphere and i'm i'm very surprised being a year away at how it's deteriorated it's disappointing and i know it doesn't represent the opinions of people in area 2 in
199large part area 2 is a very fine place and filled with wonderful people and whatever is going on here i'm i'm deeply disappointed with the with the situation i want to point out a couple of interesting facts pamela brownstein was the highest vote getter in the history of this school district she received more votes than anybody that's sitting on this board and the second highest vote getter in the school district was me i also received more votes than anybody that's sitting on the sport and that's because of the nature of area two it's the nature of involvement it's engaged voters who come out and express their opinions in 2016 i was elected with 80 percent of the votes in that district and so i'm here to present you with a choice which is to make
200an appointment and i'm putting myself out there for that appointment to serve the seven months and then hold a clean election in november and that person that runs in area 2 is unlikely to be me because i now live in area 6. as a result of redistricting the situation has changed so while i might be able to run against trustee jones i won't be standing for area 2 in november thank you president as a courtesy i would just like one to call one more time judy campbell is not with us and the wind bakes for the record not with us so one of the things i want to clarify is um why november 8th and so i know we have janet mueller on the zoom call so janet you can please come up on the
201zoom because i do think there's confusion about this we are calling the next possible election which is november 8th so if you can clarify that for our audience and for our our folks at home we can't call an election for any sooner than that is that correct that's correct can you can you all see and hear me now yes thank you okay all right thank you yes the law is very clear when we have a vacancy that has occurred at this particular point in someone's term we the only option for the election is november there isn't an option to do a standalone or sooner election and also by law based on when this vacancy occurred an appointment whether it's made you know the next meeting or through an appointment process only goes until the november
2022022 election and then we'd have to have that election for somebody to serve out the balance of the trustee area 2 term so i just wanted to make sure that that was responded to because i do think there was some confusion about that okay so in response to similar questions about the cost of a special election we're going to have to do that anyway yes yep no matter what and it actually is less expensive in november than it would be if we were the only thing on a special election ballot thank you uh trustees comments or questions darcy jones so it's it's sort of been stated here and clarified by the superintendent just now that uh well it sounded like we had two choices and we really sort of don't we have no choice as
203to whether we call a special election in november that we have to do what we do have a choice on is whether we also make this interim appointment is that correct super that is that is correct okay no matter what this will be included on the november 8th so janet do they have to call that or it's no matter what part of that we just turn in the paperwork oh i i think you just turn in the paperwork we can clarify the exact process but really the question on the table is whether to leave the seat vacant for the next period of time until the november election so you don't have to vote on both those things we believe we're just turning in paperwork for november 8th because that is when the term then is
204two more years um so you so you really have for now the choice of those two things rusty did you have a question i don't have a question but i just have a comment because i was tallying as different speakers came up um in terms of what their choice was and recognized as you did that there was confusion about calling a special so i almost wonder if some of those uh i'm wondering for myself some of those speakers who said their special election and now it's not going to be before november but they really want to wait versus an appointment so um that's all the only comment i wanted to make thank you at this time it has been um i know we have two board members christa christianos was appointed at about the same
205time the second of march february or march uh no was september september so even though an election would have been in november so there was we have i mean that has been our practice and i believe this was also appointed i don't know if it's one thing so i i think that we have common practice that that is how we have done it and to let voices be heard from a particular area so i think that that's something we consider as well i yeah i can comment to my appointment so i was appointed and trustee vulcans was as well just like trustee davis stated but i think something happened in the world right we all had a life altering event and when we have life altering events then things change right you've all had them
206and we've all lived through a pandemic or are living through a pandemic and so how i would how i got to the board i think has now changed i think that you've heard from people and they are requesting that the seat remains vacant and we can go into an election in november i think it's important to allow their voices to be heard maybe an appointment would have been something that we could have considered uh prior or not having gone through this life-altering event but since this has occurred i think the needs of the community or what would happen in the boardroom has now changed we may not be able to use that process maybe we can go back to it at some point but i think at this point for this particular seat i i
207think it's important that we go to an election i don't think that the majority of people that spoke tonight would agree that the spot should remain vacant i think it was about half and half as i took notes and maybe staff has better notes than i but i make sure to include emails though because there's a lot of emails that are coming up for both also as well correct i don't i heard that everybody said let the voters choose i agree in come november november i do think obviously we do let the voters choose that's i wish we could i wish we could have an election in two weeks and let the voters do so we're in a month i i agree i wish that that were the case but we're not in that situation
208right but i do think it's important that a voice is being represented from area two dusty um yes i mean our past practice has been the appointment process for a trustee vacancy and that was the normal practice if you will but a trustee departure due to personal safety concerns and harassment and emotionally charged board meetings that might be the new normal and i kind of feel that right now to reiterate trustee castellanos for now that's kind of it seems so quaint i look back at it that process is probably not the best for the school district to have that kind of engagement here and really carving out it wasn't it was a way to circumvent um a voters uh a voter's election um that's what we did and i think right now with more people
209engaged um looking at school districts looking at how we operate there's been a lot of rhetoric out in the world that's already we're being accused of not being fair so really the fairest thing to do is to take it to the voters of that area and so i would not support an appointment um at this juncture and in this current climate maybe in the future we could go back to that but right now it belongs with the voters of that area and um i think that's the way to go and i also support the superintendent's recommendation on that procedurally um do we need to have a motion to to go either to item 11 or 12 or do we nope you go to each item and you have we have speakers on both 11 and
21012. there is not a presentation on either of those items it's a resolution and then you would take action only on one of those two items we could could we not take that action now could we say it's make a motion and say we want to call for an election at which point item 11 would be tabled so you would take action you could take action to table item 11 so you make a motion to table it be a second you'd vote and then that item would be tabled indefinitely and then you would go to the next item and make a motion to call an election or if we want it or we just go to the next item here are the speakers and then vote is that do we have speakers on 11 or
21112 yes i'll entertain a motion for any of those options so i'm going to move that we table 11 and i want to just really quickly mention that yes there's all of this business about uh letting the voters choose but if uh someone gets a provisional appointment then they become the appointed incumbent so uh and generally the appointed incumbent is re-elected so it may seem as though the voters are being given a choice but you know the dice get a little bit stacked so anyway i'm going to put the table 11. before we get a second we need to be on item 11 four and then move and second it works from here we can we need to enter that item and then you table the item and then you because you need a second
212and you need to vote right all right i thought we could do that from here it's in the next item okay i would not take speakers on an item that no longer exists right you sure yeah we have uh miss mueller in it right at that point it seems if the board votes to not consider the item we would not hear from speakers on that item so we can can we do that from here or do we have to go on to that item before we do that well i would recommend you just move from item 10 to item 11 and open that item and then you can entertain the motion per your normal protocols thank you thank you okay unless we have any other comments on item 10 we will move to item 11
213trustee jones okay move the table and we need a second second and move by trustee jones second by trustee castillos to table item 11. this is a resolution or no this is not a resolution it's a voice book because it's just a table the end okay voicemail all in favor say aye aye aye all opposed say no okay the motion is to table item 11. okay indefinitely yes though we're voting to table the appointment yes that's the gist of it yes but we aren't taking we haven't taken an uh an action on item 12. so you wouldn't come back to this item if you table this item then that's it the item is dead and you don't come back to it do i understand the motion okay all in favor say i i i'll oppose
214say no no a motion passes 5-1 that's a referential vote of i from student advisor padia okay do we move on to trust uh item 12 or do we there's not a presentation there are speaker cards though okay i have three online speakers and one in-person speaker the first speaker is katie crocker hello trustees i do not support the tabling of item 11 i really think you don't know what you're doing there um but anyway um yeah i i realize that um i'm writing i'm i'm speaking to you regarding item 12. um i urge you to respect voters rights to vote yes on the resolution 21 22 53 the voters of areatude did not elect any of you the voters of area 2 deserve legitimate representation not someone chosen by other trustees that we didn't
215vote for please call for the election on november 8th and in the meantime figure out how to work together and speak out strongly against harassment of all board members the cost of the election is much less than what former trustee jim reardon took from the district when he sued us it would be money well spent to ensure that the parents and students of trustee area 2 are well represented thank you the next speaker that we have registered is lisa o'connell and she has not still has not joined the meeting so we'll move on to angelico sandoval martinez angelica if you are mute you can go and begin speaking we will move on to the next speaker and we'll come back to angelica she is showing up online and but unable to hear us so we'll
216come back to you on helicopter um lori mcclaskey hi good evening laurie mcclaskey i am a parent in area 2. honestly i am a bit i'm not sure about this process either you know to ask for someone to be interim appointed i think personally i think that it should be an election and i think it should be expedited that's what i think i think you should uh just go back to the you know with your legal counsel and see if there's any way to expedite an election i know it's expensive but uh it's important and that way um it would be a it would be a fair process um and then secondly regarding um i just wanted to say thank you first of all for adopting that resolution and uh we really really appreciate it
217i appreciate it i'm sorry and yeah thank you that's it [Music] so we that concludes the speakers for item 12. i just one more time want to have janet mueller clarify that there is no expediting of an election it is november 8th there's nothing this board of trustees or i can do to make it go any faster it is only november 8th is that accurate that's accurate the statute's very clear that it must be consolidated with the next board election which is november of okay trustees any comments questions or i'll entertain a motion um i'll move resolution number two one two two dash five three resolution to order an election to fill board vacancy for trustee area two second okay move by trustee hannity second by trustee jones this is a voice vote correct no
218it's a resolution so it's a roll call hi trustee police hi trustee castianas hi trustee davis hey trustee hanicek hi trustee jones aye trustee mcnicholas aye motion passes 6-1 with a preferential vote of i by student advisor one correction for the record the five houses five one i've one i'm sorry [Music] i've won so we will do all paperwork necessary to make sure that we put this election on the ballot for november 8th and in the interim we will have a vacancy in area 2. thank you we are on to item 13. this is trustee request to consider revising board policy 1923 meeting conduct party i wouldn't find that i do want to leave janet did you hear that is that a possibility okay i did i would like to a point that i would
219but i also am completely in favor of an election we confirm tomorrow and yeah i'm pretty sure you cannot once the vote is is um i had my butt i know as when the vote is then um [Music] recorded and the item is over you can't go back and change the vote it was if possible i would like that to be changed if that's possible we'll have colleen check on it but i think uh and you've made it clear to the public and people listening thank you so thank you okay we are on to item 13 trustee request to reconsider to consider revising board policy 93-23 meeting contact this is trustee castiano's thank you president mike nelson this is just a request to the trustees to bring back board policy 9323 which is our meeting
220conduct policy so it would come back on our april 20th meeting where we could look at it and then make revisions at that meeting and basically why i am wanted to bring it back is just do the pandemic and our changes in our board meeting we've had to deal with uh switching online student speakers all kinds of things oral communication so i wanted to relook at the policy and um see how other districts are kind of handling their board meetings and thought it would be a good opportunity for us to revise i don't think if i remember uh when this was last 2005 okay 2005 when it was last feeding content yeah 93 22 says okay never mind 17. sorry 2017 was our last revision so it's just a request to bring it back for
221our april oh moved i'm going to ask if there's this is an opportunity if you have any input on that either here publicly or to direct it to trustee castiano's because i think that's we've been kind of working together looking at what other other districts do but if you have any input either now or later please let us know trustee hannicek did you have something yes okay okay um so who did you move it oh lisa trustee davis moved by trustee davis secretary trustee hannah trustee politics did you have a question yes okay um so are you asking staff to do that comparison or youtube we're going to do it okay so currently you don't have any particular recommendations yet you're going to share with us your findings right and we could be thinking about
222how we but one of the things is that we talked about our practice in some ways doesn't follow what our procedure is as far as prioritizing online prioritizing students before adults um not stated so you know we kind of like to codify that we also have other other districts that do their real comments at the end of their meeting or so that your your business doesn't get you know two hours later or you split it you say we're going to go for 20 minutes here and then we're going to do the rest later so we're looking at different um different uh kind of models um martha you but where do we have blue cards on this i forgot [Music] oh sorry sorry okay but then i'll okay i'm sorry okay um katie crockett is our
223first speaker on this item baby go ahead hello trustees indeed you do have blue cards on this i am um speaking to you again after writing to you since it was pulled from the last meeting this topic continues to be of utmost importance given the atmosphere at recent board meetings including the one the the last one wherein the student advice advisor was booed i'm not sure what the intent in um potentially modifying this policy was but i'm i'm not sure the board policy is actually the issue rather i think it is the lack of clear communication from the board to the public of what is contained in the policy for meeting conduct and most notably lack of accountability for those who do not adhere to the board policy the public has the right to make
224critical and harsh remarks during their allotted time to speak but do not have the right to disrupt the meeting the board may prohibit demonstrations such as booing clapping or heckling these have a chilling effect on discourse and can actually inhibit free speech and public and board member participation some attendees seem to be mistaking a public meeting with a protest there's a time and place for both but expectations of behavior are different by generally not holding meeting attendees accountable for their actions this board has allowed meetings to be hijacked by a certain group of people who are unwilling to be behave in this unacceptable manner at public vis at a public business meeting it's essentially mob rule if anything in the policy changes i think it should be thank you katie for your time our next
225speaker is michelle colossa campbell good evening i remember when this board policy was changed in 2017 and it specifically addressed the item of consent at that time i also know that speakers get three minutes and not two minutes to speak on this item because there are only two speakers and that does not go anywhere near the 20 minutes and katie and i have been granted only two minutes but back to the topic at hand i strongly support trustee costianos in requesting to bring back board policy 323 meeting conduct as a person who regularly participates i appreciate the effort to clarify how the public can participate so please bring this item back at a future meeting thank you very much i have one speaker card uh lori mcclaskey okay i was trying to i had a
226train of thought and just anyways getting it back um i wanna just oh i know i think that you should prioritize the people who actually take the time to come in person i think that you always let online first you should have the people that come because that to me that is a that's like pretty a basic conclusion that the people who take the time to come in you know sometimes we've been here since 11 at night i think i've been here since 12 sometimes they you shouldn't make us wait to hear people who you know take the option of on online and then second of all um there's been a lot of uh you know one thing when you have a public office you have there is a different standard as an attorney you
227are i can say you are held to a different standard if you're a public official unfortunately there's going to be a you know there's a certain amount of uh words that can be spoken against you that are tolerable versus which which i'm not supporting i don't support heckling you've never seen me heckle you've never seen me boo anyone and you never will you'll never see me write any disrespectful email to anyone but that there is a different standard if you are a public official versus a lay person so these people people that are basically slandering the common citizen that's wrong you know they shouldn't be doing that so the respect has to go both ways there should be respect i'm up here shaking but you know what there's a lot of i don't like what
228i'm hearing and that's wrong too and they shouldn't be people shouldn't be generalizing like all moms here are you know whatever we've heard all that that's wrong so i'm i'm just here to say like the respect courtesy has to come from both sides thank you okay trust your politics did you was that something of our figures okay to go back um trustee mcnicholas you and i being on csva as delegates we have learned because we've asked what other orange county school boards had done we learned that in cusd we were like the only school district that would go hours having everyone be heard everybody else is keeping to that 20 and 30 minutes um so oftentimes we have updated board policies and tried to mirror csba so i'm assuming you're going to also take that
229into consideration and i would just like to say um my career my [Music] my lifetime in retail in shopping centers and i want to dovetail off what lori said is i believe people who are in person should be the primary i mean you all have to admit if you've ever been standing in the store and you're trying to get service and then they get a phone call someone who's called in and then they place that person's party and you're standing there trying to complete the transaction or get assistance so i would just say when we get into that uh my thought would be to place students always first but in person over the um they've got the comfort of running around their house waiting but these people have been sticking okay so i like that
230that comment so these are the kinds of things you'll be hearing from us i guess we did you're right there are most a lot of other school board's limited and just cut it off and that's it but they all have the phrasing that the the board by the board's consensus can can change that so you know we actually want to be rigid but we still have to be flexible on depending on the topic depending on uh what other items are on the agenda so i think we all revolve into that but i want to say based on the summer of 2020 when we were talking every other week and listening to them they weren't extending and through all this crazy pokeness they didn't extend right but then they also had this is really just an
231item to vote on whether to talk about this we're not actually talking about we're talking about whether we're going to talk about it but trustee jones this this is an opportunity to give input to so that that's why it's not being voted on tonight that's why we didn't try to come up with a redline version for you okay to put the ins in person speakers first okay it looks like you got some support for that okay so that this is just letting you know that we're going to bring it back i think that's the end we have something else you actually need to to vote so you continue to decide to bring this back hope to bring this back so yeah you have a motion a second well that's right we did have a motion
232in a second yeah i'll assume i forget okay uh voice blue focus okay move by trustee davis second by trustee hamachek all in favor say aye aye all opposed say no passes 6-0 with a preferential vote of eye by student advisor five years move to a term [Music] second hey move my trusty jones second by trustee games to adjourn the meeting all in favor say aye aye [Applause] i'll both say no pass a sixer with the preferential
