010your sound our technical people are saying yes see share sound yes it was is on my end I'm I apologize for that so I'll start the video again uh coming back to Campo and just being environment at school has been a lot of fun cuz last year all at home on a computer and it just didn't wasn't the same experience but now we're back I can actually meet my teachers and hang out with my friends again so definitely something I'm grateful for and I hope we don't have to go back online I bre um I went to a small middle school and being able to be on campus my sophomore year is giving me a chance to actually meet people and it's been really nice having a lot of friends and stuff my experience coming

011back to cappo has been very hard transition but I'm working on it and uh I'm looking and I'm looking for a fun senior Year my experience coming back to Capa has been uh a little bit different but it's been very good coming back and being able to learn in person Trav go from like nothing in Middle School to having a really fun high school year coming back to imprison school has been really nice because I feel like my education is a lot better better in person online school is kind of difficult for most people I feel like cuz it was hard to focus and we didn't get that like iners connection with our teachers so that aspect of inperson school I'm really happy to be back um I'm really excited to be able to go

012to dances and football games and that kind of stuff cuz I am an ASB so planning those events is really fun and I'm just really happy to have the student body back together and I'm hoping that we'll be able to make that next step further and once Co is away everything can go back to normal coming back to school has been great it's been fun to see everyone again and I think my favorite part of it is like talking to people again seeing how much everyone's changed since Co and like being able to do football games and like dances in person and all the stuff we missed out on uh coming back to C and just being environment at schools let me go back one okay so finding ways for everyone to get involved here

013at cappo so um here at cappo we have monthly intramural tournaments um some tournaments we've had are spike ball ping pong and cornhole we also um in September we tried this new event here at cppo it was called controlling cppo it is a large group virtual Team game where students can um play on their phone and it was a weeklong event and every single day students got to play virtually um a different game online and then outside of um tournaments we have activities and projects that we do for fun so we did cookie decorating we did shirt painting and we also did tie-dye shirt making just for a way for students to get involved and have some fun at school so so these are some of the campus Spirit weeks we had at cappo um

014it was to way to raise awareness for important issues that impact our students um starting us off in September with suicide prevention week we covered our school with inspirational posters um and we worked with our counselors who helped give us resources and lessons to support mental health and bring more awareness to our students in just our overall campus um next in February we had not in February in October um we had breast cancer eress week where we decorated our school and we distributed shirts that had breast cancer awareness um the symbol on it and then we pass up bracelets to the students um we did this to honor those in our community that have been impacted by breast cancer and then last week we had Red Ribbon Week where we wrapped red ribbons around the

015um car door handles on Friday um to remind students uh to remain drug and drug and substance abuse free and we did this um the week before Hollow Halloween to ensure that students you know were reminded the dangers of drunk driving and the importance of staying um and having a life being drug free so Capo Arts um here are Capo but we have a lot of art programs and our ASB class likes to Showcase these program so to do that we had art week where we had performances by the art programs we had theater we had um choir just different performances from the art programs um along with like fun activities that students can do to show their creative side so we had chalk art we had um bracelet making with those beads we also

016did um face painting and then outside of artweek we have um in our ASV class we have art Commissioners who work together to um celebrate artists at our school and this is done through artists of the month where we have two students selected by their teachers in art programs be recognized for their um dedication and hard work um outside of that we have music recommendations for songs on our um ASB Instagram and we also highlight student artists in performances has seen through both artist of the month and then also just art week so Capital performances so the theater arts program just had their fall play Puffs um before they before opening night we had our ASB class write good luck letters to all the seniors in cast crew and Tech just a sh appreciation for

017them and to wish them good luck into um a fall play that's been long awaited for them um they have an upcoming winter musical Elf the musical we hope to see all of you there if you have the opportunity it is from November 17th to the 19th at the cappo theater outside of the theater program we have marching band field shows we had one in October 16th and we have an upcoming one in November 13th and then we also have an instrumental music concert on November 10th so capito Athletics so our Boris water polo Boris cross country our football team our girls Golf and girls tennis all qualified for CIF playoffs um on our football team our quarterback Trey kukuk set a new single game OC record of 615 passing yards and six touchdowns and

018then our boys cross country placed four runners in top six to win the second consecutive League Championship so supporting in teams so this is basically just our student section called the cage um some football themes we had were Gold Rush blackout and then a western out and then we had targeted themes like a camo out where we honored our military and First Responders at this football game we had the military come out and um it was just to honor them and then for a pink out we coincided this with breast cancer awareness week and this kind of spills over into volleyball where we also had an orange and yellow out where we coincided this with Su Suicide Prevention Week additionally we had a h um a homecoming out and then for this it was during

019homecoming week and we had formal clothes wear outside of like the targeted dress up days we also had a fun dress up day where you dress up as your mom and dad which was a lot of fun a lot of the students enjoyed that and then for girls volleyball we won OC student section of the week um we won this on the OC student sections Instagram so these are some images of our student section on the left we have our student section at a football game during a blackout and then on the right is our student section at a football game during a gold rush okay so homecoming so this year homecoming theme was lost in Wonderland it was a take on an Alice and Wonderland theme we had over 1,400 students in attendance at

020the dance and during homecoming we have a weeklong event each day being a spirit day and a lunchtime activity for students to get involved and kind of get them excited for homecoming um for a lot of students this is their first dance back and we wanted to start off the year strong and just kind of um re-engage the students and kind of build that tradition and Community we have just fun dances here at cappo um on Friday we had a halftime show put on by students this is another way for students to get involved and get excited um it was basically student ran and this is during the halftime of the football game and then on that Saturday we had our homecoming dance and on the right you can see we had um a ferris

021wheel and we had a swing Along with Just Like Music and dancing we also had an area for students to relax and not be dancing we had games and we had water and food there too okay steam Showcase in the DIA deos morto celebration so steam showcase is a community event we have at cappo um diis mertos we had a display there from the two-way immersion in World languages program at cappo um we also had science demos by OC science trunk Retreat from clubs where clubs could engage with uh children within our community and pass out candy to them we also had robotics demos um a costume contest student music and dance performances arts and crafts and then also an engineering demo so second semester events so second semester we have winner formal prom air

022guitar and quad Chella air guitar is a tradition we have here at cappo it's basically student performances and a competition setting um all the students um get into a group um and they compete against each other we have at the end of aatar we have two winners we have the crowd favorite and then we have a judge of plan lists who are judging them based on um creativity and just like overall like uniqueness and the ability to be funny and you know try to like be entertaining um we have the judges then pick a winner based on those qualities and then quad Chella is a new tradition we have a cappo and involves a whole Community with local bands food trucks and more and is hosted by our Arts Commissioners and that is it thank

023you all for your time and I appreciate it I'd now like to ask our superintendent Kiren Bal bruy to present this month's comments great thank you and good evening Ryan thank you it's so exciting to see our students back to so many normal activities and fun so good evening and Welcome to our November 3rd business meeting of the capistrana Unified School Board of Trustees I understand that tonight there may be some parents or community members here tonight to speak about critical race Theory I've been asked many times if we teach critical race Theory here in Capistrano Unified the answer is no we do not teach critical race Theory otherwise is known as CRT I also am asked about whether our social emotional work specifically our cultural proficiency lessons have any critical race Theory woven throughout

024the answer is no we are not hiding CRT in anything by using words like Equity or cultural proficiency or racism these are not words and they are not they are not words connected to CRT we are promoting inclusion and safety and acceptance for all if this is not your experience in cistron UniFi I ask that you email your principal the district office me at Superintendent at Capo usd.org we will fully investigate any issue we are here to support our classified staff teachers and families in Partnership to educate our students with kindness and understanding our cultural proficiency lessons introduce students to age appropriate material promoting empathy belonging compassion understanding self and differences being an upstander conflict resolution stereotypes Prejudice identity and effective communication and problem solving skills the lessons are evidence evidence-based and age appropriate the

025lessons Empower students to be up standards and to Value cultural differences as assets on which education experiences are built students will know how to work with collaborate and understand people in a diverse world one lesson is provided to each grade level once per year and takes approximately one hour of class time the mission of the cistron Unified School District is to prepare our students to meet the challenges of a rapidly changing World which is a world that is increasingly Global and diverse these K12 lessons were created as part of cusd cultural efficiency plan adopted by our Board of Trustees in 2020 and our valuable resource for our students as we prepare them for success in their Journey After High School and graduation So speaking of our students educational Journey last month I shared some incredible

026work going on in our elementary schools that's being funded over the next two years from state and federal fed Co funds tonight I want to share about the Investments we've made in our secondary classroom our secondary students are engaged in small groups receiving extra time and support from our teachers and staff and receiving targeted intervention we're providing much needed support with a focus on exactly where students need it as we move through the school year these classes are evolving into exactly what we imagined small group instruction targeted instruction and clear entry and exit plans for students I'm grateful for the efforts of all of our teachers classified staff and administrators for working collaboratively to use these state and federal coid funds to support learning acceleration and the needs of each and every student this is

027the work that will pay off in enormous ways for our young people both now throughout their educational careers in C cusd and beyond that concludes my report thank you trustees any comments trustee Jones hi I know a lot of people are concerned about the governor's prop proposed Co vaccine mandate and parents sometimes write me and suggest that one District or another is not going to follow the vaccine mandate and one that was I was told about was Murietta Valley Unified School District so I Googled Murietta Valley vaccination and the third item that comes up is titled Governor's Co 19 student vaccine mandate I'm want to read part of it it says as a district we are obligated to implement and follow State and health state health and safety code requirements laws and regulations and vaccination

028requirements our School Board District administrators principals teachers and staff are not involved and do not have jurisdiction in this process or decision making as we understand and pro this osed requirement the cdph will initiate the rulemaking process and write regulations that will address the vaccination requirements uh vaccination requirements if you have opinions that you would like to share or provide input into the RO Ru making process please direct those uh questions to the California Department of Public Health or our local representatives and of course they list their own but in our district it's assemblywoman Lori Davies and State Senator Patricia Bates so I would like to make the same suggestion not only to those opposed to the proposed mandate but also those in favor of in favor of it let the cdph and our local

029legislators know in addition cons consider writing letters to the editors of the voice of Orange County the LA Times and the Orange County register as proposed the Mandate will not be enforced until the co 19 vaccinations received full approval and right now only the the fiser commity vaccination has full full approval for ages 16 and up as far as I can tell no Co 19 vaccine developer has requested full approval for younger age groups younger than age 16 but when they do the first group to consider these requests will be the fda's vaccines and related biological products advisory committee those interested in whether the vaccines receive full approval and thereby qualify for the Mandate for younger populations may wish to contact the members of that committee and it's probably better to S send paper letters

030rather than email I realize it's easier and pro possibly more satisfying to engage the CD board on this matter but I believe it's much more likely to be effective effective to contact those I've suggested tonight thank you any other comments from trustees okay our student adviser Kai Pia good evening everyone thank you so much for joining um I would just like to thank the board for the addition of the cultural proficiency uh curriculum uh I definitely strongly support this and I believe that it's a great starting point towards the right direction um as we all know racism is a problem and it is a form of bullying in our society and I think that the best way to decrease racism is through education um school's job is to educate and um I think that this

031curriculum will definitely help um shape broad-minded people along with that I would also like to introduce a tutoring platform that our district is providing it's called paper paper is a 247 platform that's available to all students free of charge um students can access paper via clever um using their school account if parents or students have any questions about paper please feel free to email me I would be more than happy to get that to you and that's all I have to say thank you thank you I do have a comment um I want to give a shout out we have a very exciting event coming up this weekend uh the first in Orange County U Back in person it was exciting to see what cappo is doing and seeing these kids back well this is

032the first inperson robotics competition it's called Beach Blitz and it is c usd's um robot Dolphins from outer space team 5199 is hosting this event we have 36 different schools participating coming as far as Idaho and Hawaii um and we are fortunate enough in trying to share and accommodate all the different activities and cifs going on that Elisa Niguel high school has been kind enough to let us use their gym for the cusd um event so we do have um more and more coming back in person but we still have this lingering coid thing so I'm afraid I can't invite you to join us there this weekend uh Saturday and Sunday but you can live stream and tune in to either twitch YouTube or periscope to watch this event for two days and uh I

033just wanted to share that with 36 teams there um we're really excited that we're able to host this and be able to show off cusd um and our um 5199 team so that concludes my comments thank you canai for mentioning about paper so I didn't have to it's wonderful we're now going to move uh the meeting to the portion of oral com uh Communications uh the total time as I had mentioned in my intro is 20 minutes um three minutes normally per person but we do take a look at how many people have asked to speak okay we have 25 speakers trustees um so I would ask you um what is the pleasure of the board in terms of uh the allotted time that we want to give uh 25 speakers during oral comments do

034we want to stay with the three minutes or do we want to reduce it down to one minute does one minute okay we are going to give each person one minute so those listening please take a look at your notes if you've got notes don't try to read three minutes into one minute because a lot of it gets kind of lost pick out your key points and um please keep it to one minute because we will keep to our timetable so I'm going to ask Mrs Hayes to uh check to see if we have any student and uh from there go into um uh between the blue cards in person and anybody that is um connecting with this telephone thank you we do not have any students so we'll start with our online speakers our

035first speaker is Leanne Williams hello thank you so much um thank you board members Administration for hearing my comments I just wanted to take a moment to thank you and to express my gratitude for your guidance through an unprecedented time and history our cappo kids have continued to grow and Thrive and to learn we are thankful that the schools opened early and that the safety measures were implemented and enforced I also want to express my support for the cultural proficiency task force and everything that's been um the progress made in that area this work is ensuring a safe place for all students while providing a strong education for everyone also as a district we are looking forward to emerging from the pandemic stronger wiser more diverse and ready to face the future also we look

036forward to the approval of the social studies curriculum this has been hanging in the balance for far too long we hope that it is approved and implemented quickly thank you again for striving to balance academic social emotional learning and safety while we survived this pandemic let's put aside our differences and boldly move forward thank you very much [Music] lean our next speaker is Michelle colossal Campbell good evening superintendent Board of Trustees I am speaking tonight representing only my family I great appreciate our trustees who listen and to and think about all the citizens of our schools not just the whining complaining ones that are creating inspiration for SNL skits on a monthly basis in boardrooms across our country parents who support Public Schools don't call in or show up to say thank you for doing

037a good job on behalf of our kids as often as we need to but we are saying it by not coming in and yelling by not sending iate emails but tonight I want to publicly say thank you to our trustees who try to present the best reputation for capist unified who don't propose half-baked resolutions on items that they cannot change or resend but who speak with voices of common reason ones who keep focused on how every dollar is spent needs to directly benefit students outcomes and who work to create schools that become centers of our communities thank you our next speaker is Michelle brislin Michelle Michelle this hello can you hear me yes go ahead hi um my name is Michelle brislin and I've been a cusd um teacher for the last um 15 years

038and I wanted to just first of all say thank you to all those that um helped support when I when I spoke back in May I got a lot of Facebook messages and emails and verbal support for my speaking um at that may board meeting we didn't speak till about 1 in the morning so I really appreciate it and I also want to thank the board seems to be the theme tonight thank you so much for sticking around and letting us speak well after the normal Meeting hours um that meeting exposed me to other perspectives that I had not thought of and caused me to pause and think even research what others were saying I'm in support of the agenda item 31 cultural proficiency for exactly that reason is important that we listen objectively and

039respectfully to people of all backgrounds how does one learn this we learn this we have to move on speaker thank you for your time we have to move on to our next speaker Jessica gu good evening superintendent president bolus trustees and student adviser Pia I believe in public education all the best all the basic principles of it and through the effects of the pandemic how much it impacts my family and my children's lives how my school district pivoted and provided Alternative Learning environments and my children's teacher adapting to a whole new idea of what public education looks like during a pandemic so although this public education is far from perfect um sorry I shortened my thing and that doesn't make any sense anymore any anyway I believe in public education I believe in our District

040staff and I believe in our trustees I don't agree with them all the time but I believe that they are a part of the public education that is necessary I highly doubt they got into this elected position for the money or the super awesome clients that sing their praises all the time they do it because they believe in public public education too so thank you for conducting the B the business of this board and believing in public education next we'll move to our inhouse speakers um I'm going to call 10 names please line up in the center aisle we'll be using two microphones tonight please stand a few a few um about six inches away from the mic so we don't get feedback and that will hopefully speed up the process as we move forward

041this evening the first speak 10 speakers on Sandra Miller please come forward and on Deck we have Jeanie wicker Anna Stevens Vicky orloff Jenny Loya KY CR Shannon doy and Margie Sandra go ahead I'm actually Jenny if it matters but because she's trying to cut it down so okay one I wanted just to thank you guys um the board for voting yes to move forward on the resolution two weeks ago to urge Nome to reconsider and do away with the mandates I appreciate that four out of the six voting board chose to stand up for our kids and fight for us and I understand that you know to to reach out to other people and what you guys did does make a difference to us parents you guys were thank you thank you um I

042would also like to point out that there would be huge financial impact if these mandates go into effect when you're giving the parents the only option is to pull their kids out of the public school system it's going to have a huge impact um a lot more than receiving coid funds from the state and federal government um I'd also like to ask this board to reconsider placing any vaccine Center distribution kios or anything of the like with Distributing vaccines on our campuses I just want to reiterate that the campuses are place for Learning and not thank you thank you [Applause] um and please state your name are you Sandra yes okay thank you Sandra go ahead good evening my name is Sandra Miller and I am a concerned parent I was at the last board

043meeting and urged you to firmly declare that the school district would not enforce vaccine mandates what an eye- openening experience that was I could not help but notice those of you that seemed angry that we would even object to having our right to make medical decisions for our children taken from us I didn't see a crowd of parents opposing our call for freedom of medical Choice did you you are our voice your personal feelings aside you were elected to represent us the parents and children of this District this made me wonder why the district wasn't taking a harder stance on this didn't take me long to zero in on item number 19 on the agenda from the October 20th board meeting it describes a save return plan and it had two conditions to receive 35

044million from M funding which amounts to $815 per child the first condition was that you would have to adhere to California Department of Health safety recommendations which include vaccination the second was to accept this money the second condition was to was to ensure the continuity of service including but not limited to students academic needs thank you our [Applause] next um since it's impossible to fit things in in a minute I'm giving Sandra my minute um we I'm sorry with the transfer time all right well then I'll just keep reading hers no problem and before you start ladies and gentlemen if you want to show um your favoritism to what's been said if we could hold back on the Applause and as some started if you wiggle your fingers and hands we will know how you

045feel also president buus folks are cut off and you don't get your me your time please email us uh your entire speech app now thank you yes thank you right now the two conditions are in direct conflict with each other there is no way for you to ensure continuity of services if children cannot attend school if they are not vaccinated you cannot ensure their social needs are being met because you will lose them to alternative education options they will be separated from their friends because some parents will make the decision to pull their children out of school causing them emotional harm unfortunately there will be some that will have no choice but to comply how will you ensure their well-being if the long-term effects of this shot are not known they are already talking about

046a fourth booster what will be your response if that child has lifelong vaccine injury will the $815 be worth it I wonder if you consider that the loss of Revenue per child will be significantly more than $815 when parents are forced to unenroll their kids from this school district because you did not make it perfectly clear to the governor that you will not be party to stripping parents of their right to make medical decisions for their children so now my request reest is urgent since the FDA failed to protect our children and thank you Anna our next speaker is Vicky orlock I'm here sorry I'm here tonight because I really do believe each and every one of you cares about our kids and you're not doing it for the paycheck and I believe that the

047majority of you think that we should have our choice as parents of whether or not to vaccinate our children but I've heard s of you say that you just don't feel like you have a voice and you don't have the power and trusty Jones I I'm doing everything I can from my from my spot but we're a big district and you are our voice and I was doing some research about the role of Board of Trustees and it's literally to be an advocate for our community and for our kids and for our schools and so that's what I'm asking you to do tonight and I'm asking you to use the the growth mindset that we are teaching our children and that you probably all voted on to try fail and learn so I want you

048to go out there and try and if it doesn't work I want you to try harder so our next speaker and yes uh Miss Jones is correct there is no FDA approved uh vaccine City only had its biological licensing agreement uh approved uh yesterday it was an eua for 5 to 11 years old which they based on the fact that they did not have enough evidence to know if it was safe and said we'll never know until we start giving it to the children they also have changed the formulation so that the buffer is different and is the one that is in madna which can cause more heart issues and is actually reason why madna was has been paused in many other countries they it is not the formulation that they did the trials on

049that they are now proposing to give to the five to 11 year olds and I thought this is information that you should know because they are lying to us all and using our children as guinea pigs and it is not right I have an autistic child who is vaccine injured our next speaker is Casey trance can use both the microphones if you want to go back and forth okay good evening my name is Casey crowns and I'm a proud mama of a nine and fouryear old and we live in St Clemy my husband and I are strongly against vaccine mandates especially for our children the infection rate for kids under 18 in the US is 0.007% putting poison into their healthy bodies is not the answer there is no long-term or medium-term safety data available

050on these vaccines the short-term data is concerning to say the least according to the cdc's vs database more than 17,000 people have died from taking these vaccines where there is a risk there must be a choice for our family the risk does not outweigh the benefit the coid injections do not stop a person from Contracting or spreading the virus at best they off offer superficial symptom management for some data from around the world shows these injections are failing miserably repeated boosters are not prac iCal or sustainable and will lead to more adverse reactions and deaths please do the right thing fight for our [Applause] children next is Shannon sorry this one hi my name is Shannon sasta and I have been a uh resident of San clini for 21 years I have a 13-year-old daughter

051attending middle school and she's an advanced student I uh this is my first time ever being in a board me board meeting I voted for a lot of you and I have trusted you in guiding our our children in their education and I believe that we should have a freedom of choice for our children because this is about education not medication so I just I mean the children were playing if you think children were not playing the entire pandemic they were and I I saw them in my blocks so they have been together the children are not the problem and we should just have freedom of choice for our bodies for our children there are children we should have the choice for them that's all I have to say thank you good evening and thank

052you for listening to the overwhelming majority of your constituents regarding the Mandate from the last meeting I'm doie I'm in RN I have three kids and I represent a large group of moms here in the OC called moms in charge I know many of them are so busy that they are not able to show up often so I'm here on their behalf and on ours on mine as we saw last night in Virginia and all across the Nations parents have awakened they have been shaken from their Slumber in some of the fiercest ways over the last two years and moved them from apathy to action Once Upon a Time in 2015 from the capital steps in Sacramento I spoke and asked the parents this question what moves you back then there was only a small

053movement because the issues at that time were not seemingly so egregious however they are now being threatened with some of the most overreaching detrimental mandates for our kids I can be very clear in letting each of you know tonight that the parents here in this District have been moved I'm here to remind you that we will not allow these vaccine mandates that have no basis in science safety and Truth to be allowed thank you next we have Margie black evening all my name is Margie black I'm teacher in the district for over 30 years I'm also a resident of Dana Point a mother of two Bri and one the daughters and the daughter of a 94y old I'm a third generation public school teacher I'm a voter I'm a volunteer but mostly I'm a teacher

054it is who I am and what I do I've been there for children as Wars erupted through 911 parents divorced pets died parents died fires burned and now global pandemic but enough about me I'm here because we packed up the Jackal lanterns and moved into November it's one of my favorite times of the year it's time where we as families neighbors and communities pause to give a collective thanks to those deserving so thank you thank you for approving workplaces which provide a safe environment for all of our students and all of our staff the policies you have supported have allowed me and so many others to remain safe and healthy and do what we do best so thank you your actions have allowed me to feel safe thank you I'm gonna call the next 10

055speakers Teresa Teresa R Wendy melish Anna Baldridge Jim Burton Chad Laura conect Shannon Terry Dr red and Ronda Wayan and Geor this so we'll start with Teresa Rish go ahead hi I'm Teresa Rish I have three kids and cppo I will be pulling them out if this mandate goes through I'm gonna play something for you from FDA advisor Eric rubben did you guys hear that we're not going to know how safe it is until we just start giving it that was in reference to our five to 11y olds I don't know about you but if you in good conscience after hearing this clip can allow our children to be test subjects this is straight from the FDA you will be held accountable if you choose to enforce his heinous mandate you will be liable for

056many penal codes including child endangerment and child abuse the definition of a mandate is the command the message given to an elected official by the votes of the people this is authoritarian authoritarian and we vote no our next speaker is Wendy myish hi my name is Wendy melish I have been a teacher in the district for over 21 years I have four boys that attend the district uh 2 grade fifth grade eighth grade and 11th grade and I want to thank thank you for the decision you guys voted on last time to not to tell the governor not to mandate the vaccine I want you to know that people have told me and my family homeschool them leave California go be with people that think like you I don't want to leave my kids don't

057want to leave this is my district these are our schools this is our community these are our friends and I just urge you to please still stand with us parents that need to make choices I often tell my students and kids don't rush into things rushing makes us make improper decisions and we're asking not to rush into this decision to give us time to find out what's really going on please let my boys still attend this school and the districts thank [Applause] you next is Anna bald my name is Anna Baldridge I had three kids in the district when I spoke to you two months ago and brought The Bullying of my son going on at a Royal Vista and Miss Batel said that she'd reach out to me that never happened I'm repeatedly disappointed

058on H how cusd treats their special needs kids two weeks before school started this year I requested to have my son fully tested because of behaviors I noticed last year when he was home with me all year and two and a half months later they finally finished unfortunately I had to pull my two youngest out of ab because of the The Bullying by both staff and and students and every parent I've spoken to about this long and painful journey of recognizing that something's not right with how your children learn child learns and then having to fight like hell to get them tested and services say the same thing fight the school they don't want to test because it's expensive don't sign anything because they want you to get less help than you can for your

059child why don't you want to help these kids Jim Burton Wagner good evening board members I'd like to thank those of you who did vote for sending the letter to Governor Nome and I'm here just to lend my voice to all the other parents to urge you to be our voice you're saying very often the choice is not yours it comes from above but that's not entirely true because you do have the choice to say that what you're suggesting to do is wrong taking Choice away from parents around medical decisions for their children is wrong especially in this case when one this is not a vaccine like other vaccines that have been mandated this is experimental gene therapy the phase three trial for this will not be completed until 2022 2023 which means saying that

060we're going to inject all of this into our children is imposing all of our children into Gene experimentation you are our voice to say no that is wrong and we will not comply I do hope that that is what you will do and if you don't you're going to see a tremendous loss to this District Chad Jones good evening I'm Chad Jones and I'm a father of three beautiful daughters that have been part of the school district and for the most part I do want to say we have enjoyed the school district it's been a wonderful experience although there has been a turn of events that has occurred and and we've all been swept up into this Mania that has overtaken our our country and this world and my message to you today is simple

061is to remind the board of who you are and who we are you are employee servants you made an oath to serve the people you serve us we do not serve you that is correct is it not um and I'm here to remind you of that that you are our voices we rely on you we ask you we implore you we can demand you as an employee servant to do certain things not mean not hateful we're just asking you we're imploring to you because we are the people we hold the power in this country that's how it's supposed to be but somehow that got all screwed up Laura all right good evening uh let me start by saying we've been very satisfied with Marblehead Shore Cliffs and S clementy high school we were happy with

062all our principles and most of our teachers Through The Years however my husband and I decided to remove our youngest child he's 17 and 11th grader we took him out of the school this year and we got a loan to pay for our 11th grader to go to a private school we chose to put put his health uh before everything else uh we didn't want him wearing a mask for most of the day nor risk the chance of online school again he lost a year of academic Excellence like so many others he was isolated disengaged and caught cheating on his phone by me several times at home I want to say that I feel bullied by this vaccine mandate I feel like we are being Boxed In by a big bully I voted for a

063you uh uh I voted for a few of the board members here and I trust that you I really want to finish um our next [Applause] speaker please email us your full speeches um I I had a lot to say but because of the time limit I'm just going to um shorten it up um I'll be repeating a lot of what the others said but what I want to remind you is um you guys represent us you represent the students of the this community and um and you look at look at the sheriff in in Los Angeles he straight up said that I'm not going to enforce his mandate you don't have to take orders from from from Newsome he's not he's not a king and you are supposed to uphold the Constitution it's not

064it's not about following I mean this this mandate has not no basis in science they're just bullying us it's up to you to stand up to them and say no you are representing us and that's what you're supposed to be doing thank you hi good evening members of the board uh my name is Shannon Kane I'm a mother to two uh in cusd uh e8th grade and fourth grade um I too Echo the sentiments that a lot of people have stay here this night uh this evening and I appreciate your bravery for doing so um I also want to thank the board for having the cusd co dashboard it has been a real eye opener in terms of the visal numbers in terms of positivity case rates uh in the last 14 days I think

065we had a total of 67 staff and students out of all of C USD tested positive over the last 14 days uh that equates to about 0.15% of positivity I'd ask each of you here tonight to dig deep think about the number of hospitalizations the number of deaths and all of cusd in similar schools across the state dig deep you are a voice you are public servants for us um yes I'm going to reach out to the California Department of Public Health because they're going to require this at the end of January probably band together all school districts across the state across the country need a band together this is not right it is tyny experimental drug any [Applause] story Terry M Terry's not with us I have Dr ryad would you pronounce your name

066if I did it Dr Ra FAS good evening everyone I want to thank you for giving me a minute I am here to ask that everybody wear a mask call it a face diaper whatever you want to call it it is absolutely essential for everybody to put an end to this pandemic it is not the vaccine that will cure us all or fix us all it is simple it is absolutely simple if we had better government better leaders better examples if everyone can wear one we would have had this nipped in the butt from a year and a half ago to years ago almost we wouldn't have had this crap take over not our country not our schools and certainly not needing a vaccine to fix us all or to neuter us all or to

067take over our lives or to sanitize our schools this isn't the way to go about life I don't think any of us here tonight wants to leave the state or the county none of us want to have to be cornered or pressured um none of us need to be subjected to this it is common sense if we can be better examples thank you next we have Rhonda whan and Joyce Snapper little okay um good evening superintendent vital and president bolus and the rest of the trustees we stand in front of you this evening to show our alliance and comaraderie for the students of C USD we believe that students come first and their education is of the utmost importance it is the basis for how every decision is made during these tulous times we have

068committed ourselves to collaborating through the systems we have in place including the district Cape team and regular touchdown meetings with different District departments such as HRS ESS and special ed we've always made ourselves available to have difficult and sometimes intense discussions with the intention of solving problems and providing outcomes that promote a pro positive School climate for our students none of us signed up for this work with Co in mind but here we are faced with the ongoing issues and concerns that this pandemic has created we have relied on each other to make it through this together while always keeping students at the Forefront of our minds you have our commitment to continue the work with CD and the Board of Trustees as long as we are always looking out for the students we serve

069oh I get another minute us I only have one more paragraph I could have done Martin Luther King Jr said we all we may have all come on a different ships but we are in the same boat now as we are all in the same boat we want you to know that we are committed to rowing together towards the same common goal providing students the best education possible thank you that concludes our oral Communications and now we're going to move to the consent calendar please note that per board policy 9323 and in accordance with the law the public has the right to comment on any consent item at the request of any member of the board any item on the consent agenda may be removed and given additional consideration my name goo Davis I didn't

070hear Davis inad of Jim maybe yes Doo I have you signed up to speak on item 31 we're not at item 31 yet oh sorry thank you that's okay gin we'll be with you shortly um so in regards to each consent item um we allow three minutes per item this say let's see do we have any speakers we have one speaker for consent item number three did you say 30 three sorry would be three okay Molina Pini Oh I thought I only had one minute so I cut it down I'm Molina felen I'm the PTSA president from Dana Hills High School and I'm here to support the approval of the architectural and construction contracts to build a new two-story building at Dana Hills High School every day I'm astounded by the quality of the education

071our students get while funding is so little while I understand somewhat a little bit why our schools are in such bad physical condition I firmly believe our students deserve better a clean and safe learning environment are crucial to a Student Success and mental health Dean Dana HS in particular serves deserves this new structure located in residential Community Dana is the second oldest school in the district and it is yet has had little upgrades in physical improvements compared to many of our other schools Dana Hill's High School serves over 2,000 students and all the students from the two feeder middle schools six elementary schools will also benefit from this new building the combination of the prop 51 matching funding and the seismic money opportunity offer a unique opportunity specific to Dana Hills so please consider approving

072approving these contracts so Dana Hills can serve as a visible model for rejuvenating all the Capo schools thank you yeah okay uh trustees do we have anyone wanting to pull a consent item trusty mcnicholas I would like to pull item number three and ask that it be considered before our consent our um discussion action item rather than after please but you'd like to move it up okay normally we do our consent items after discussion yes respectfully request we do it before before number 30 okay that as well thank you okay do we have any other consent items to be pulled okay I think we're all in agreement um um that we will put number three before number 30 do I have a motion to approve one through 29 minus number three so moved moved by

073trusty mcnicholas second seconded by trusty brunstein student adviser Pia I trusty bronstein hi trusty bulus hi trusty ctios hi trusty Davis Hi trusty hanich hi trusty Jones I TR mcnicholas I motion carries 70 by a roll call vote to approve the consent calendar with the exception of item three and a preferential vote of I cast by student adviser Pia that takes us to discussion action items and we will start with number three um yes I have pulled this item and I want to thank Molina Pini for speaking on behalf of it and for Dr Baker for being here in support um this is I'm not pulling the entire item but just the contracts for LPA Incorporated and for telu they are the contracts for architectural and construction management contracts for new twoot a plan new

074twostory classroom at building at Dana Hills while this is just the beginning of the process it is a step in the right direction this classroom building is intended to replace aging Portables and will be funded by prop 51 state m in funds generated from previous new construction as uh Molina mentioned there's it's been a long time since there's been anything new at Dana Hills uh over 15 years as a matter of fact and that was science buildings that are actually considered um Modular Buildings that's when my daughter was there 15 years ago um public presentations of this project and other plans for the future future improvements at Dana Hills our plan for next year right Clark yes okay when the when the architect has designed the building and the plans go out for bid after

075they're approved by DSA there will be a presentation to the board with the renderings to show what the building will look like when the bid the bid goes before the board for approval okay I guess my question to you then is also are there plans for any interim discussion and Comm Community engagement in that process because the um after DSA approval we're talking like a year from now well prior to that we'll be working with the school site directly on uh the the building the design uh things like that so we don't we're not you know we have an idea where the location would be but that would all be dependent upon geotechnical evaluation things like that and then the um the building will work directly with the school site U for the design of

076the building I'm really glad to hear that because it's a my I'm absolutely supporting this item uh and I'm supporting um improvements Dana Hills 200% if I can I just was worried that this was buried in a list of contracts to be approved and I just the reason I brought it Forward is to make sure the public knows we are moving forward on at least this part of uh redesign of Dana Hills I know there's potentially more in the future but we need to get this this going if there if there AR any other comments from trustees I will move approval I had just have a quick comment I want to thank truste mcnicholas for Champion us and moving it moving it forward these are the exciting things that we like to kind of touch

077on not buried in the consent um also just having gone through our other three new buildings I do respect that our staff and our team will come up with as you did with all three other buildings even when the weather was inclement uh under under budget and under time so we will look forward to the same thing happening for the Dolphins um and then also the elements that they're actually simple when you look at so many of the other complex opportunities that are other schools at past School bonds but I also recognize that you guys will do a great job creating a building that the students at at Dana deserve so thank you again Martha and we will look forward to um having a ribbon cutting so I have a motion on the floor um

078from trustee mcnicholas and seconded by truste Hanah roll call vote all those oh all those in favor say I I I any opposed 7 Z motion 7 Z thank you and and the preferential vote from our student advisor Kai Pia okay we are now on to uh agenda item action item number 30 uh resolution number two 2122 D21 establishing criteria for adjusting trustee area boundaries and tonight to share uh information about this redistricting we have Clark Hampton our Deputy superintendent business and support services to present this item thank you president buus trustees so every 10 years the school district uses the uh the the census the federal census to determine uh trustee boundaries and adjust them so that the population of each trustey boundary is roughly the same so tonight we have District legal council

079Ron wart to present an item and also the district's demographer Ron Van Ordon is here and they'll provide a brief presentation to let trustees know where the 2020 census has come in and where adjustments are needed and what our next steps are and then to approve the resolution once it's um finalized with any changes that we may have for tonight thank you thank you for that uh introduction Clark it's a pleasure to be here it's been a few years since I've been here uh it's nice to see everybody um so I'm going to give you an overview of the uh process for adjusting trusty area boundaries and then I'm going to turn it over to Ron Van Orton and he's going to go through the uh demographics of it so let's see did I the

080middle button oh there it goes is that oh I think it went too far see no okay there we go okay so the tonight we're going to be talking about resolution to establish criteria for adjusting trusty area boundaries and provide uh Direction on a number of options so that's that's the timeline then at the next board meeting December 15 there'll be a hearing on the maps themselves uh and uh then direction to the demographer for possible revisions January 19th we'll have um revised plans and reive Direction on any revisions to be prepared for final adoption and then final adoption would be February uy 16th 2022 so as you know there's seven members of the Board of Trustees each board member has to reside in their trusty area and only the voters who reside in that

081trusty area vote for that board member representing that trusty year that's the by trusty year election system as opposed to an atlarge system uh that may have been uh had in the past the elections are staggered with three board members elected in one election and four board members elected at the next election federal and state law require that trusty areas must be equal in population that's the one of the Bedrock principles uh of uh trustee areas and a portion of districts one uh one person one vote uh that the Supreme Court rendered a number of years ago so they it doesn't have to be exactly uh uh population has to be uh less than 10% it could be uh you know five 6% but cannot go over 10% so due to growth in population over

082a 10-year period now that we've looked at the 2020 census results uh we've got a situation now in the in the in the district where the population varies more than 10% from one the most populous trustee area to the least populous trustee area so Education Code section 501 9.5 requires school districts to adjust the boundaries every 10 years and based on the Census Data that was released in September 2021 uh We've determined that adjustments need to be made so this the statutory deadline for uh completing the process is March 1st 2022 so that timeline we laid out in the first slide is designed to meet that deadline uh and if the school district for some reason does not meet the deadline then the Orange County committee on School District organization makes the final adjustments uh

083so the you uh to make these adjustments it requires the services of a demographers we've got Mr uh Ron Van Warden uh who's been retained by the district uh and then the the demographer reviews the census data and determines where those shifts in population have taken place and Designs the maps uh to meet the criteria that are required by law so uh as I mentioned if the trustey areas are all within 10% range they don't have to be adjusted but in capist Unified School District there's been a lot of population growth and so they're not within the 10% range so they need to be adjusted uh okay so I think the criteria for adjusting those uh boundaries are laid out in the law and we put them in the resolution uh you passed a similar

084resolution a few years back when you changed uh the election system so each trustee area has to be nearly equal number of inhabitants has to be drawn in a matter that complies with the federal Voting Rights Act so it can't be gerrymandered uh it should consist of contiguous territory in as compact as form as possible shouldn't be any dilution of the minority vote you have to respect communities of Interest as much as possible follow Municipal boundaries if possible and take into consideration the location of the schools okay with that I'm going to turn it over to Mr van Orton and let him talk about the de uh demographics Board of Trustees good evening so my role here as a representative of the demographic firm that the district contracts with is to talk about the data

085uh the analysis that we performed and we I can talk in general terms about the process that we would go through to create new trustee voting areas uh Mr Winker covered most of the rationale and the uh reasons why um but in brief what we did was we do have your boundaries digitized your trusty voting areas and as Ron mentioned we got the new census data in and effectively all we did was a comparative analysis between 2010 and then 2020 this is just a quick look at the boundaries that we have um a little bit hard to see from my see here but you can see the different truste areas 1 through seven and then you will see here um and the the number I'd like to direct you to is up in the upper

086right I can use this pointer uh is that 51786 number that is effectively the total population divided into sths so you will notice that Tristy area 2 in particular had a significant amount of growth we do know that um there is some new housing um that has taken place in that area and you can see a breakdown of the areas that have had change over that 10-year period uh in short if we were to just using population balance as criteria divide the district voting areas into s we would be aiming for that number this is just another um look uh something to point out is trust area two again an area that did experience a lot of housing growth um is 122 uh per above the ideal of that 51,000 number and so uh in

087conjunction with Legal C Council um and based on the criteria you lay out we will uh effectively have to reduce some voting areas and increase the population of others in order to bring those into population balance uh so at that point that is really my review I'm happy to enter uh Endeavor to answer any questions that you may have or generally in these processes some may be of a legal nature so Ron's best answer best suited to answer that and I would answer anything in the technical or bound creation process side thank you before we get into questions we do have two speakers the first Michelle plel Campbell good evening superintendent Board of Trustees I'm excited to see the red districting process started tonight especially with the maintenance of seven trustee areas to ensure that

088all communities feel supported and heard our district covers almost 200 square miles and it takes many individuals working collaboratively to create an excellent School District trying to keep the area boundaries as contiguous and compact as possible is important I look forward to seeing the draft maps that come back in December 2021 and I will give further input then thank you next speaker is Jessica guire good evening superintendent pre president bolus trustees and student adviser Pia I appreciate the district's transparency in the process of adjusting trustee area boundaries I look forward to listening and learning to how the maps will look once trustees have added their input and appreciate the timeline that has been established for this work thank you okay we only had two speakers on this agenda item I'll open it up for questions

089or comments from trustees trustee mcnicholas I just want to make point out that to anybody listening this is trustee area not High School boundary because that's usually what um people ask me on oh well wait a minute you you aren't changing the High School boundaries no this this does not have anything to do with High School attendance boundaries this is our representation of the area and while we have seven trustees and only six Comprehensive High Schools you know we'd like to say oh we our area is right around our home high school well it the numbers just don't work out that way we have other high schools that are not Comprehensive High Schools so but just that's more of a a comment to the public who might be listening and worried that the High School

090boundaries would change this does not affect High School boundaries this is our election boundaries thank you okay thank you that's a nice introduction to my comment I'm going to step up next um I would like to consider an addition to the uh criteria the seven points that um are on the uh resolution and um trusty mcnicholas just spoke to it being uh not being that the students would be changed at all in terms of the high schools but my addition would read truste area borders should take into consideration the School feeder patterns into high schools in that um many of us uh trustees over the years who have been in this role um were once very involved in our schools um we're known in our schools and in terms of um the families who know

091us from elementary school into Middle School into High School uh when it comes to we over uh priding over our area although each one of us oversees all the schools we just have the areas in which we live in um I think it is best to for the candidate um of any position um for them to be a part of the community that knows them um and truste mcnicholas had mentioned in regards to we have six and why we mentioned that we have six schools is that one of the joys of our position is we get to attend and reside over High School graduations and um most of us many of us do attend our continuation schools graduations um so we all kind of share in that um at this present time I am trustee

092over area 7 which covers Mission vijo Rancho Santa Margarita and Coto deaza um my children went to Bathgate Elementary school went to New har and then went to cppo Valley high school but I don't oversee cppo Bley high school as a trustee I oversee Torro and the middle schools that flow into Torro um are not a part of my boundary so I'm in hopes that we can kind of look at school feeders uh in terms to the high school and so that there's longevity because that's how a lot of families get to know their trustees representing the area uh and so I'd like consideration that's my only comment I'm excited about this project thank you so TR president bz so just to confirm the exact wording you would like to add trusty area borders shall

093take into consideration the School feeder pattern into high schools yes and I basically copied that off of number seven but um just adding in the school feeder pattern um with consideration into flow into the high schools so prior to to board consideration can I ask legal council to this to provide an opinion on that for it being added yeah and again it's just consideration I don't know if it can be accomplished it would be permissible to add that criteria onto the resolution uh we would have to factor it in with all the other considerations equal you know population contiguous and Compact and so on we could certainly consider it so do other trustees want to add that to the resolution would be the conversation absolutely I think that makes perfect sense again I'm just asking

094for consideration thank you go ahead trusty mcmas on the other hand okay and it affects my area too that the area that I live in includes Danny Hills High School but does not include Miguel Hills Middle School that's in trusty Jones area area however all of the people that live in my area their kids go to Niguel Hills well the build building is not there I still represent those families whose kids go there so I'm not I mean it'd be nice if if everybody we had perfect feeder patterns and we all you know lived together and all went together but that that can't always happen so I'm okay with unlike your situation where where you live and the people in your area don't go to you still need to represent them even though they go

095to Capal and Capo's building isn't physically in your area to Sor is and you don't have do you have anybody in your area that goes to Tora High where you live that goes to Tora High School knowingly two families that that that I personally know well I guess that's my my point is yeah it' be nice as a consider eration but I don't think it I'm looking more at the area that I represent I represent those people wherever their kids go to school right well just for clarification um not to get too personal on this I I have adopted kappo Valley high school because I know it so well my kids went there you know so I I was there at that school for six years um but we are elected officials we get voted

096okay name recognition matters in elections and so if I were to decide to um run a campaign or anybody else um that possibly lives in Mion bejo had a child go to cappo they have to talk you know they have to campaign to people who may not know them because they live in another area so I I it happens only one out of the seven areas um boundary areas it happens to to be mine but for anybody who's going to be in this position in the future or any of your areas that might get changed in this process um it's something that I would like to do just as I made up my own map and preparation for these conversations I think that trustee MC migl should have Miguel Hills Middle School because she doesn't

097have one so we'll see what kind of maps that you create for us well we'll see what we can do I mean we have to divide it by seven and you know and it depends on where the population is and we have to make sure that we don't dilute the minority vote and we need to make sure that it's equal in population and it's Compact and contiguous so we we'll uh we're taking notes and we'll do the best we can yes so also I was wondering about Lera Ranch and how that's going to configure that being the largest area trusty area two two trusty area two so that's a growing and there's still growth that's happening there so will that take take into the consideration there that that will maybe be the smallest area and

098that the two that will grab some of that will take into consideration that that area is growing yes we have that as one of the criteria in the resolution that the areas where there's the most growth that we may underp populate those at the lower end long as they stay within the 10% range so that we'll that will uh take into consideration the projected growth for the next 10 years thank you trust Hanah um so I think I'm I'm actually just more interested in creating that Equitable dispersion of numbers of people and making sure that your subgroups that you had referenced are you know represented correctly as well um I don't think I I I think more in terms of we are V we are elected by our area but we serve and vote as

099a whole so I'm a very odd um was drawn before my time I got on in 2012 so I have three cities um people go everywhere my home city of Dana Point they don't go to Danny Hills High School so the whole idea of a little bit of I get it the name recognition Etc I think you really it's really more you're Geographic you're representing a kind of the geographic area that you live in you kind of know that area most of people around me are old so I'd love to say we had a bunch of kids and I could really think in terms of schools but it's really uh being able to represent that my fiduciary responsibility the tax fairs and understanding where they are so I'm not I don't really want to get

100bogged down for this school district we need the flexibility of movement and we always have uh we it broke my heart years ago when we went from the neighborhood school system to the School of Choice uh but now I'm used to it people people love it we have concept schools and so it's almost impossible to have kind of that ownership of it so I'll be interest toed what you come back with um um if you can give me High School okay so that would be I go anywhere they tell me to at at a graduation day that's more of my mindset I'm really just thinking I'm representing my geographic area um and there's a reason often times why voters live there uh what's important to them and so and so forth we we'll do the

101best we can and we'll come up with some options for you to consider trusty get that wrong okay so I agree with um uh trusty Davis's comment that um the largest area right now in terms of Voters is area two because it has experienced the most growth in the last 10 years although they were all fairly close 10 years ago um and I feel like we ought to um and no offens me to uh truste bronstein but I think it would make the sense to make that the smallest Within in legal limits this time because it's going to continue to grow more than any of the others will continue to grow because of Branch home Mission Vio just getting started and they are there's many hundreds of thousands more I exaggerate but many many more

102homes will be built there whereas the rest of the district very few homes are going to be built uh in the next uh decade um but I also wanted to respond to the idea of of feeder pattern my current trustee area there are students who attend if their homeschool if they live if they go to the school that's assigned for their boundaries uh to Alisa Miguel to Danny Hills to Kappa Valley and the S sanon Hills and that's not because I lived in some kind of weird gerrymander District it's because of just how things are there's no way to make it all work out perfect I think a few of us are sort of for fortunate in that all or the majority of our um trustee area goes to one high school but it's I

103mean believe me it's like it's all over the place there's just no way of doing it um so and I think perhaps trusty mcnicholas and I were the only ones presently on the board who attended some of the sessions 10 years ago when they were doing this and I heard all kind let's do it by Elementary School let's do it by Middle School Let's Do It by High School let's do it by this let's do it by phas of the Moon and there was all kinds of opinions and this what was landed upon was just a compromise um we they did their best um so it it's a it's a great idea but I'll tell you what you're going to go out there and you're going to try the same stuff that they tried 10

104years ago and uh we could get get some of our old board members here to relate because they were it went to more meetings than I did but how it went for them and they tried and there just was no perfect way to do this yeah what you know if you had seven high schools and they all had equal population it within their attendance boundaries then we could divide it up evenly but that's not the case it's never the case I haven't seen a district where that has been the case but we'll try to give you some options and we'll take all the factors that you mentioned into consideration and uh give you a few options to consider and if you want to make adjustments to those options then we'll we'll go back to the

105drawing board and come up with a few more maps okay thank you thank you I can I ask one more question sure when you then present to us at the December meeting um the 15th the different options um will it be Maps broken down that we would get a sense of the population will it actually be mapped on it or a charter anything um let Bron because we've got these top side numbers but when we looked at area 2 for example and you know it's a huge land mass first of all but we don't know what the population is there it would be great if we were able if you were able to share with us what the populations are in the different throughs uh yes so we can the the deliverable will bring back

106will have maps of the adjusted truste areas and we will have all the corresponding data alongside that so generally we will have an individual slide for each area we'll talk about the modifications that were made um and then the rationale the data behind why we had to arrive at whatever scenario we we arrived at thank you any other questions ask for a motion yeah so the board will have to take action on this resolution so I do want to clarify on behalf of the team whether you want us to have something that says consider as best as possible family patterns or just leave the resolution we just need to I think clarify that point is there another Point Clark that needs to be clarified yeah there was another so the first item consider adding is

107item eight is the trust area order shall take into consideration the School feeder patterns into high schools and then the legal council said that would be fine if the board were to approve that and then number nine trustee Jones suggested something along the lines trustee area borders shall consider expected future population within a trusty future growthy area over the next 10 years something like that two items we suggested we added to the resolutions I thought Mr Banker said that was already in there I may I didn't I didn't see it I may have I may have misspoken because I've done a lot of these resolutions for different districts and I may have that may have confused it with another District so I apologize but if you want to add that that certainly would be fine

108to add I think it's important to add it okay I in agreement on both I think both are important to add both of those as considerations I'm happy with the with the demographer attempting to do what has been described by trusty Davis truste bulas but I'm concerned that we could that the progress could be hobbled by that if it just so I corre is that can't if you can't get it exactly be the same numbers and then one of the maps might have trust area to that has it's still within the accepted criteria but on the Lower Side to consider what the expected growes in the future now we when we do this we'll look at what R&B has plans for because a lot of their plans have Chang as far as their construction schedules

109homes so could be I think I mean they're going out to 2036 so we'll consider so may maybe we don't change anything we've just given some verbal Direction and that's good enough is that all right if we just you know I I'd like to Define that number one through six says shall follow we have very specific things we must number one each trustee area shall contain a nearly equal number of inhabitants habitants um the seventh one that I was mirroring says truste area borders shall take into consideration the location of schools and then subsequently my number one eight and number nine would be shall consider so we're saying that very specifically these last three are shall consider considering is you know it can happen but there's the first six criteria we're really having to follow

110and make sure that we got those six things with except it says as much as possible which one as much as possible yeah because it's not an exact right as Ron mentioned there are certain specific pieces of this that are required option so in our work you know it'll effectively we will um only present scenarios that meet those required criteria then it's really a subordinate second pass that we do that try to meet all of these considerations if it's not possible we will absolutely come back and say you know here's why consideration A or B was not possible it would have you push this out of out of balance population wise or have implications for voting rights act so we'll definitely come back and and speak to what considerations were we were able to accommodate

111what we were not okay yeah as long as it doesn't like box you in I'm fine with that I I I just don't want you know some you know Wonderful uh otherwise wonderful plan to be disrupted by some you know criteria that we set yeah just just two points of just clarification make sure that you understand the work we'll do one this is adjusting the existing trustee boundaries so this is definitely not a Crea new is taking the existing and then modifying them enough to bring them into to compliance uh the second piece is uh there very well may be may not be able to accommodate the criteria or the the requests um because it may or may not bring that out of compliance the last piece is regarding trust area 2 um we do

112we are required to use the 2020 Census Data the number that is of today um we can push that slightly below the ideal to accommodate for that future Pro trusty mcnicholas yeah my concern on making a decision now for what we think might happen in the next 10 years because we've done that before and then there's been a recession and that didn't never happen and you know it's like taxing me on what you think my house will be worth 10 years from now like that that that's that's the only thing that worries me yeah I think you're correct that we can't for sure know what's going to happen in 10 years and if there's a lot of growth it's going to exceed the 10% and you'll have to make adjustments 10 years from now regardless

113but we can you know uh try to at least make that at the lower end uh so that it it's possible you may not have to make adjustments 10 years from now so is the board am amable to adding the two considers that um Mr Hampton read should we read them again so then some someone can make a motion including those do I'll read again so number eight will be added and it would be trustee area border shall take into consideration the School feeder pattern into high schools number nine will be added to read trusty area borders shall consider expected population growth within a trusty area over the next 10 years within each trusty area over the next years they moved second okay moved by trustee Davis and seconded by trustee mcnicholas all those in

114favor nope it's a right the student adviser Pia hi truste bronstein hi trusty buus hi ctios hi trusty Davis Hi trusty hanich hi trusty Jones hi trusty mcnicholas I motion carries 70 to approve resolution as amended and read into the record by Clark Hampton number 22221 establishing criteria for adjusting trustee area boundaries Mr hon you the second item that is recommendation is the number of maps for the board to consider in December so the demographer can come up with various scenarios I would let the board know that it wouldn't be reasonable to have like 10 different Maps because each map you have your options to make adjustments your recommendation is three or four so I asked the demographer to First provide what he thinks would be a reasonable number to consider our recommendation would be

115three and so if we get these three and we can still tweak them at the next meeting right like oh no take these two streets over here and move them there okay okay we'll follow up on three that'll be like a Christmas present on December 15th thank you and and if we like the maps then it's really one that we will enjoy [Laughter] unwrapping okay we are ready to move on to number 31 which is a the cultural proficiency quarterly report and I'm going to recognize um Gregory mwin our associate superintendent of education and support services to present this item and this is information only nothing that we have to do action on this evening thank you very much president Bas trustees to presented the all duties staff presents item 31 culture proficiency cor report

116this is the second of four reports this school year on our progress on this very important and impactful multi-year plan tonight's item in the report highlights progress on several of the action items in the plan we've included progress regarding talking points texting program which is up and running to enhance communication at our private schools additional professional learning for teachers and administrators transition to academic counseling and planning for the College and Career Centers at our final high schools please know that when we return February 16th for the next quarterly report we will be bringing with us student data toward academic goals and other student outcomes that are included in the plan uh before I open it up for questions I would like to also bring your attention one of the important developments and that is the

117online resources specifically regarding what culture proficiency is and what it is not so these resources are now linked to the online Family Resource Center which is accessed from our school's website and also from our district website so very easy to find these resources as we have shared on multiple occasions previous board meetings and as our superintendant did in her opening comments we do not teach critical race theory in cusd and cult Prof efficiency is not the same as CRT it does not include CRT in order to clarify how we do not teach critical race Theory and how it is not part of culture proficiency one of the resources that we have included in the online Family Resource Center is a critical race Theory FAQ and this document is from the California School Board Association as

118well as a link to easily access the culture proficiency lessons so the public can easily compare and see for the themselves how critical race Theory and cultural proficiency are not the same if you click on the links you'll see the mission of culture proficiency and that is to increase learning outcomes for all students by engaging in ongoing reflection to ensure an inclusive environments for student staff in the community value diversity that is the mission of cultural proficiency and the lessons as the superintendent stated support this work through promoting empathy appreciating differences addressing bullying and resolving conflict so clearly cultural proficiency is not critical race Theory and we encourage the public to read for themselves in the Family Resource Center and clicking on the culture proficiency and culture efficiency lesson links finally I would I'm very

119pleased to introduce behind me and long at last as we've all been awaiting his his arrival Mr CUO graan executive director of culture efficiency equity and social emotional learning and other education and support services team members are also here tonight we are here to assist with any questions you have thank you trustees we have a total of 18 speakers this evening uh at three minutes that would put us into almost an hour 54 minutes uh do I have a recommendation to reduce the time to accommodate hearing from all 18 speakers can we maybe do two and I know folks would wrap it up because this is very student Centric I think it's important to hear um as you know as much as the comments we have because this is actually ongoing happening work that's happening

120now so if we do two minutes then we're talking about a little over half hour 36 minutes are we agreeable to that okay uh so we will call upon uh I will ask Mrs haes to call upon the speakers and we will give them two minutes for agenda item 31 cultural proficiency orderly report okay we'll start with our online speakers first up Susan saso hi good evening everyone um my speech um is also for your information only um my name is Susan and I have three children in this District uh as we approach Thanksgiving I'm here to express my gratitude I'm grateful for the cultural proficiency plan and to everyone involved who is working hard to make sure that we achieve the goals set forth and make progress towards complying with The Fair Act of

12110 years ago and the cusd resolution which was unanimous unanimously passed last year stating that we are committed to equality diversity inclusion tolerance and human and civil rights for all I especially appreciate the Improvement in the school counselor to student ratios the developing College and Career Centers the unconscious bias training and the online resources for parents regarding CR which I've gone through and is really really informational so thank you for that I also want to thank everyone including teachers administrators in the board who work so hard to get our kids back to in-person instruction and are doing everything possible including following the cdph guidelines to keep our kids safe from coid um and I'm sorry that some of you on the board have been bulli called names and dehumanized during these meetings and on social

122media even though I may not agree with you on everything uh for example the last two resolutions uh that were not pro Public Health I I especially disagreed with um however uh I do thank all of you for your service and I hope that in fact in cusd there is no place for hate uh so thank you to all of the administrators the teachers and everyone on the board that's all our next speaker is Vanessa Santos hello uh my name is Vanessa and I have two students in the district I wanted to speak in support District promote I heard we should Vanessa we're having a issue so we'll have to come sorry okay you're like coming in and out okay might my Internet it's kind of dropping on let's come back to her let's see

123if we can let's come back to her okay we'll come back to Vanessa our next speaker registered is Ivan Del ala I don't see Ivan listed as registered to speak well he's registered to speak let me uh rephrase that he's not online with us currently so we'll go to the next speaker Bethany Padia Bethany go ahead hello everyone um my name is Bethany Pia I'm a senior at s CL high school and I'm just going to speak today on behalf of s CL High School Against Racism and also as a member of um my school's no place for hate committee and I just want to thank our district members and everyone in this community for um supporting this cultural proficiency plan it is so necessary in maintaining progress toward an aware in supportive educational environment

124um as we still see actions of like hate on our campuses which we are resolving much quicker and in much um more supportive and inclusive manner I just want to celebrate our efforts and I want to stress that this plan is so so important um yeah as a community we are not like predominantly white and our students of color deserve this support and attention um in a very intersectional way and yeah I'll give my time to the rest of you guys I just want to thank you and I support this plan's um future in progress thank you our next speaker is Alan ho I think you guys can hear me now all righto all right hi everyone everyone my name is Alan ho and I'm currently an English teacher at sany high school I would

125like to address you all about the district's cultural proficiency plan specifically that some members of our community have mistakenly labeled at critical race Theory and are opposed to its inclusion in our district first and foremost critical race the is something that is taught in law school I would know I attended and graduated from the UC Davis School of Law additionally I actually took the class critical race the specifically focuses on and quote from the syllabus from the course the Constitutional and statutory framework for remedies for racial discrimination including the Reconstruction amendments and original contemporary civil rights statutes if that's hard to understand it's because it is and it's not meant for our students this is not what the district cultural proficiency plan does instead it focuses on creating an inclusive environment where diversity is celebrated

126not shunned and this is something that the district desperately needs while some may argue that such education should occur in the home and outside of school and I don't necessarily disagree the reality is that unfortunately that does not always occur the sad truth is that prejudices and racisms exist within our district and after a certain incident a couple of years ago students at sanan high school detailed many accounts of the Discrimination they encountered regularly and this is in part what the cultural proficiency plan has a potential to address especially in a world that is becoming increasingly Global and diverse we cannot ignore or deny the testimonies of the students who face discrimination just because we might not experience it our elves instead we need to educate all of our students so that all of our

127student body so that such testimonies won't exist in the future thank you for giving me this opportunity to speak about and supporting a program that creates a safe positive and inclusive environment for all of our students thank you Alan our next speaker is Mina Carson Mina good evening superintendent and trustees I just want to say that my family and I fully support the work of the cultural proficiency task force and of the cultural proficiency plan this is important work and we thank you for your support of it our next speaker is Michelle colossal Campbell good evening superintendent Board of Trustees I support the work of the cultural proficiency proficiency plan I am excited to see the work already completed but no we still have work to do our district is stronger for the diversity of

128our students we need to create academic learning environments where all subgroups are performing at high achievement levels this doesn't mean holding back some back but rather providing support as needed for all to achieve at a high level it is about tailoring and individualizing our programs to meet the needs of our students I appreciate the work done through this plan and the ADL at San Clemente High School to create campuses where students are starting to feel seen and heard where safe spaces are being created for all students I look forward to hearing more about this work at the next quarterly report in February thank you our next speaker is Michelle brislin I don't have Michelle With Us online at this time next speaker is Michelle mcnut Michelle go ahead hi are you able to hear me

129yes go ahead thank you my name is Michelle and I've had three children in cusd schools over the last 11 years and I just want to thank all of you for continuing to support and move forward with the cultural proficiency lessons which should also include meaningful conversations about race and racism thank you for valuing inclusivity and diversity and I look forward to the February update including student data thank you so much the next registered speaker is suzan sarento I don't have her online with us currently next up Jessica guy good evening superintendent president bolus trustees and student adviser Pia District staff welcome U Mr graan we are happy you are here thank you for your continued work on this plan the updates are very helpful in determining the progress I am particularly interested in the

130topic of AP for all because I truly feel there are some building blocks missing from this particular model AP for all starts at 12th grade in a government class but I feel like that model is almost too late if the goal for AP for all is to just have more students take an AP course we have missed a lot of components does the data support that it is that simple I appreciate Dr merwin's clarification that student data will be presented at the next update and I will look forward to that High School counts grades are important and affect your college admissions why start a pathway at the end of high school um or is Middle School somewhere that a student can explore an accelerated class have teachers help develop uh study skills and literal literacy

131skills refinement and work in an increased Pace without the stress of failing and it being on their permanent record and affecting their JP uh GPA students need building blocks prior to an AP course we have accelerated and honors options that are being completely skipped over to take to take a student who has never taken an AP course and putting them in one even if we are asking them if they want to try it or not is like taking a student who has never played volley giving them a ball a net a court and then putting them on the varsity team the skills are just not there but accelerated in honors courses could be used as stepping stones for students to start honing those skills necessary to succeed in AP courses in high school thank you

132our next speaker registered is Ella Mitchell Ella hi yes go ahead good evening superintendent president bulus and esteemed board members my name is Ella Mitchell and I'm a junior at Toro High School I am also a semi-finalist for the State Board of Education student board member position I'm speaking to you today in support of the cultural proficiency guide it is important to recognize like the agenda states that the cultural proficiency guide is not critical race Theory also known as CRT it is crucial to pass a cultural proficiency guide to actively create Equitable schools uplift all students in policymaking simultaneously engage other students in diverse excuse me Diverse perspectives and ensure every student's voice is heard and acknowledged it should be a given that students feel safe and respected throughout their education students in this capar

133Unified School District deserve to learn in a space where inclusivity diversity and Equity are a priority and with the implementation of the cultural proficiency guide this Vision can become a reality thank you for your continued updates on this plan and thank you for your time our next speaker is mili Wilkinson she's not with us online we'll move on to Julie little Julie go ahead hi can you hear me yes go ahead okay hi um just a few thoughts on the no no place for hate assembly that just happened at anhs on Tuesday um principal Hatcher sent an email home yesterday and I drafted an email back with some thoughts and concerns regarding this program which I'm not in favor of um and I'm just going to kind of go through that because I didn't plan

134on speaking tonight in his email we said um we are currently or sorry we're working towards becoming a quote no place for hate end quote school we are current are we currently a place for hate has the administration sent out Communications indicating that we are a place for Hate Now thus needing to become a no place for hate what is the focus here we're focusing FOC using on hate what is the goal are we focusing on spreading love and acceptance or are we focusing on not hating there's a big difference when we collectively put our energies into something that's what we produce so the focus of not hating will put an emphasis on trying to pull out and point out different ways that people can feel hate it would seem like a much better use

135of time energy and teaching to focus everyone's Collective energies and efforts on spreading love kindness joy and peace wow what a better world we could all live in if we could focus our energy on those things and not how people hate hate is divisive when you focus on hate you produce more hate love kindness and acceptance brings people together creates a community that we all want to be a part of now my question is this what are you trying to spread are you trying to spread the ideal of Love kindness acceptance togetherness and peace or the idea of not hating you may think they can produce prod the same outcome but I would venture to say that it does not thank you at this time I'd like to go back to Vanessa Santos and see

136if we have a better connection Vanessa are you with us yes hopefully I'll try again I'm gonna get to know the beginning of my speech very well um my name is Vanessa I do have two students in the district and I wanted to speak in support of the work the district is doing to um bring along the cultural curriculum I heard a quote recently that instead of glorifying Our Heroes we should focus on the heroics being truthful about the fact like a man like Thomas Jefferson owned slaves and had children with one of them Sally hemings doesn't take away from the fact that he wrote one of the most significant pieces of text in regards to Modern democracy instead of focusing on Jefferson as a hero who did no wrong we can focus on how

137he was an imperfect man who did some heroic things I think focusing on inclusion helps us see that none of us are perfect or without fault we are all imperfectly human and capable of heroic things I'm concerned about the dangers of platforms like Facebook where disinformation and hate spread due to their algorithm that is focused on keeping people angry whether it's the vaccines masks or critical race Theory I will concede that wokeness can become a competition of who is woke enough and I know how hostile that environment can be we can't let that stop us from sharing historical truths or not addressing inequities in our community we should all be able to agree that every child who steps through a capistran unified school doorway should feel seen and loved the cultural proficiency curriculum is about

138trying to tell more diverse stories so this can happen in classrooms today in my young one's kindergarten classroom I found out about a Thanksgiving play that is going to be telling the story of pilgrims and Indians Native Americans is what they said but they are going to be dressing up in costumes and reenacting the Thanksgiving feast that happened I think I think there are more Forward Thinking ways that we could approach the story of Thanksgiving rather than the old adage of a Thanksgiving play where students have to dress up as Native Americans thank you so much at this time we'll move to our speakers who are here with us in the room first up is Mark enm then Gino Davis Lori mlki and Kelvin moski Mark go ahead hello thank you for allowing me this

139time to speak I just wanted to give my appreciation to the Board of Trustees for Having the courage to implement the cultural proficiency plan in our district comes at a pivotal time in our history according to an FBI report last August hate crimes throughout America are on the highest level in more than a decade in Orange County alone hate crimes were up 35% from 2020 to 2021 especially against asian-americans which saw a 106% increase as a world history teacher in the district I'm trying my hardest to incorporate more diversity into my curriculum every year but try as I might our textbooks are designed more as a western Civ course and I cannot say that I give Justice to the richness and uniqueness of cultures that encompasses all of humanity when we as a democratic conglomeration

140of cultures and that ities from around the globe share and learn from the experience of others we find that our commonality and Humanity outweighs the divisions that breed hate the implementation of this cultural proficiency plan is one of many tools that our community needs to take in order to end the stereotypes that separate us decrease the rising violence on our streets and add a firm pillar in the foundations of our democracy again thank you for your work work in making this happen next speaker is Dino Davis thank you board this is the first time I spoke on these so a little nervous but um anyway third generation Mexican American you guys already said it's not C CRT but we also said 15 days to slow spread so it's slippery slope it might just go into

141it um it's kind of belittling to say that my family didn't make it here because of my skin color or because of their skin color I know I'm a lighter Mexican um it's just mind goling and for other people to applaud it and say oh my gosh this is great we're finally doing something for them that's ridiculous um racism yes it was alive yes it was there I've never experienced it my family's never experienced it we lived in six or seven states now never once in any of those states have we ever been introduced with racism um talking about it and I think it's a slippery slope and I don't know kids wearing masks child abuse and this list could go on and on um thank you for sending the letter I appreciate that just

142I have three kids in this cppo of two right now one will be third um we will be taking them out if all these mandates go in and this is a slippery slope I just hope to God that we all really do care for our kids we're in their best interest it's not about money and really find it in your hearts to really push this beside us and just better future for everyone I know we're all into that and we all want that and let's move on and like I said no place for hate no place for all this this whole Co and everything has bred that it's like enlightened it it's made everyone be able to pick a side and choose it's never let's all get together and just move forward it's just this

143way or that way this way or that way so I'm just here to be you know my family's made it it's great I live in Laguna Nigel now used to be homeless like this is it's not because of my skin color it's not it's because we worked hard it's our character it's how it should be and it's America so God Bless America love you guys thank you I know you our next speaker is laori MOSI hi good evening um discrimination a widely accepted definition of discrimination is treatment or consideration based on a class or category such as race um as you know I'm a mother and I'm also an attorney um I'm just looking at the cultural proficiency plan of our school district which says by June 2023 suspensions will be reduced by 25% or

144more for identified student groups um these identified student groups are Foster you students with disabilities homeless uh homeless students black uh socioeconomically disadvantaged and Hispanic so for so for example my understanding is a student is accused of let's say breaking a desk so basically you're going to classify the student you're GNA say if a student is uh in the category of a foster youth disability homeless black um economically disadvantaged Or Hispanic um if they would get suspended well their suspension rate would be reduced by 25% if they fall within a certain class or category now you don't need to be an attorney to know that you guys are discriminating based on a class of people which is illegal so we have numerous state and federal protections such as the Civil Rights Act of 1964 which

145prohibits discrimination based on raised color national origin we have California statutes we have the 14th Amendment which states that similarly situated people should be treated similarly so if a student commits an act which is wrong their their punishment should be color blind not based on a certain category they fall thank you miss moski our next speaker is ke hi thank you very much um well one thing I just I think I'm learning as I'm being here right I think the the beauty of America is the you know the open um debate of ideas is and it's great that there's information that you know I'm learning that everyone should learn about that it's an online resource on the family research site so I commend that um I commend the fact that there's information here from the

146California School Board Association so it just helps educate I think everyone I think we were coming through some really intense times with BLM happening where people are feeling uh segregated by their belief structure I'm born and raised raised in Southern California I'm I lead a team with my business that's the most uh diverse in our company so that's what California represents I think it's great ideas diversity and i' just say continue to share the information that we have here to help educate people about what what your goals are and what and I think kind of that's probably what's missing there some key pieces here people are focusing on some aspects of this jumping to the fact that it's um divert you know creating you know undesired outcomes where if you kind of pull back and

147understand that this was a four-year process comes from the state it's not something that you guys just created on your own and there yes there is CRT there is there's there is aspects of Marxism socialism there's also a great aspect and let's talk about them let's talk about the great aspects of capitalism and democracy and free speech and the fact that I can even stand here is you know great opportunity and every everyone should come and whatever Spectrum you're representing so let's keep that going on let's keep the the ability for the public to come here to understand and I guess one of the biggest concerns I have is the limitation of time so do things to keep encouraging this keep it open that what's makes that that's going to make America great that concludes

148our speakers for this item preses do you have any questions for Dr mwin one question um just B based thank you for asking that at trusty Brown team the answer is no the punishment is not different for the different sub groups so let me clarify I appreciate whaty was asking what we are doing is we are monitoring the suspension rates of these subgroups we are not treating them differently the strategies and the action steps are for all students to support all students with behavior so for example if you look at that same uh goal restorative practices restorative justice discipline handbook discipline training that's for all students that benefits all of our students with behavior suspension rates should come down the reason we are monitoring these subgroups in particular because there's such a discrepancy between these

149groups and the average that's why these these groups are identify not to treat them differently to but to monitor are these actions making a difference and we want to watch these groups in particular it does not mean that we are treating them differently or giving them different consequences absolutely not then I have another question because what this guy was talking about are we um looking into how we can encourage more kids to take accelerated classes in Middle School to protect them before we just throw them into the 18 and have we um really worked with sanan hills to see how it's working there the model that piloted there so yes so the two parts they're happy to answer those and have the team jump in with me uh the first part is we are very

150excited about we're looking at again as it's in this plan access increasing access for more students to Advanced courses we realize that that can't start late in the game and we need to look at ways that that starts in Middle School we're very excited to actually bring that to the board H in December as one of our items to talk about access to courses and to talk about that it cannot start when they're a senior it must start earlier we realize that we're excited to bring information to the board in December on that uh regarding AP for all let me ask either Dr heris or uh M Small if you you want to share a little bit more about that question and currently what it is and what it isn't and how we working with

151[Music] them thank you I was actually the principal at s Hill when they implemented EA for all but we quickly rebranded it to AP Dev for more so it wasn't forced upon all students but we did have a very compassionate group of teachers who did a lot of research went and visited schools that had this model and implemented this course to provide access for this experience of a college level class in high school and we wanted to particularly Target our subgroups and and give them that experience um we have a lot of positive data which can be shared at another time students really excelled in the program but the teachers were so intentional with interventions proactive information with parents letting students know what the expectations were and they embedded a lot of social emotional supports

152for the students who were firsttime AP students and so we saw incredible success the GPA overall increased discipline decreased with the senior class student surveys were very positive but there was a lot of intentional work done there and we can follow up with samon hills to see what they're currently doing to support the students that are in the program right now are there any other questions out on Hills now are we are we currently doing AP for all they currently still use all of AP for more um I think Dr mahinder car has mentioned that there's going to be some changes to it so I can follow up with them and get more information on what this will be is it the only high school that we are piloting or using or utilizing that program

153room um Toro also has an AP AP uh econ that's sort of similar they approached it differently than sanan Hills but they have all their seniors Eon other than four sections so they have a similar model at their site and were the middle schools that have theater schools for San Juan are they prepping for that is that work that's happening is that something we're currently doing or or do they just start at San one it's not connected to anything at the middle school um we're trying to do that for all students across the district so there isn't anything targeted to L ramch or Marco um for the Feer schools at San but that's our goal is to improve it for all students across the district so they'll have more success and more opportunities in high

154school to take some of the honors May classes that are of interest to yes student advisor today is there anyone to make a comment you can comment you can ask questions absolutely um but I just wanted to make a comment regarding like what one of the individuals said um just because like you know like a certain individual has not gone through racism that doesn't mean that it's not a problem I personally know a lot of students that have gone through racism it is a problem in our school district and yet again I'm going to repeat myself but I think that this cultural proficiency program will help make everyone feel included okay trusty Jones well I have never been a person of color but I have been a woman in my entire life and as a

155woman I have experienced gender-based discrimination bullying and harassment and if a woman who is part of 51% of the world population is experiencing it I can certainly understand that people of color would be I also want to read uh part of an email I got from a parent um who said after five years abroad I recently returned to life in the US after living abroad I fully recognize the importance of Val valuing all cultures and America's unique history in this regard one of the most characteristic elements of America is that we are and we're designed to be a pluralist pluralistic society our founding principles clearly emphasize American has promised to fully include and provide opportunities to people of all ethnic religious cultural socioeconomic backgrounds and abilities and as an American I'm very proud of that

156fact and I think that that is really what our cultural proficiency plan is all about is bringing that uh to Bear to uh fruition thank you I have a question and I'm sorry um I missed a revision but um on page two under the header of cultural proficiency task force and the reference to the management Dei uh guiding con um Coalition um it states that we will have all the members of the Coalition by November 2022 is that supposed to be uh this month 2021 I hope [Music] yes thank you we'll we'll correct that then for the books um and then I uh moving further up the page for strategy 3.1 professional learning um we had great success you had great success um at 98% of your Kuma um getting trained and then it mentions

157about the access and Equity um and I know you've got a follow-up training but we only had 36 who attended I'm not sure why such a low attendance but my question is do we keep having the trainings until we get to 98% you know 100% or do we only have these two planned and we're hoping to get the balance in to to get you know another 200 trained on the access and Equity part because again I see that 200 staff members like the the kuma um have the unconscious bias training so I want to see that all the different initiatives we get you know participation so how are we addressing that thank you president Bas looking around the corner is is so I'm GNA ask L to show more on that okay thank you so

158much Dr merman so I understand what you're saying um president buus what the access and Equity cohort is like a deeper dive so last year we had about 20 district office um and a couple of principls and maybe a teacher or two um they took that training and it was really what spurred the development of our cultural profic proficiency plan so that team that went through that 10day training um they were reading the cultural proficiency handbook they were um collecting all of the data and it was that work that really um along with the work of the task force that drove the plan and so we have had the opportunity so many of us were saying we did a book study on that book and that was also part of um a suggestion that that

159group had brought back to our um district office leadership and there was just so much interest in doing that particular training um that we had 36 people sign up for it and there was a cap because of space and it's in person um and there's a it's very um like the unconscious bias that you and I did um they capped that as well because they really wanted it to be intimate because the topic can get pretty you know um pretty personal and pretty deep so that's what the access and Equity cohort is so there's 36 of us it's over two years and we're participating in that the kuma the 98% for our Kuma management that's our 212 Kuma managers certificated and classified and we have n it's really like 98.5% because we just had a

160couple people that you know were um ill when we did the makeup training but that's a really great um percentage to have our management trained so we're really focusing on that adult professional learning right now and you know having our managers trained getting teachers trained over 200 our up to 200 staff have already been trained in that um unconscious bias and at the end of December and we'll report out on this in February um all of our school sites would have been trained in all four of those implicit bias modules so we are you know um following through with getting that adult professional learning and that deeper dive in those topics for our adults that um work with our students thank you for that clarification you know I just love being on a school board

161I did such an education are there any more questions yes trusty mcnicholas um I only see one place in here where no place for hate is is mentioned as far as um I think it's training of site Personnel to support like being uh clubs and um programs on campus um how does that fit in with the over all cultur proficiency plan is it something that we are is our goal to have all of our campuses become official no place for hate schools as couple of our speakers mentioned and we got a couple of emails about um are we requiring a certain percentage of our students to sign a pledge and then because of that then they become a no place for high school uh tell me a little bit more about no place for hate

162so I'll start and then I'll ask the team to jump in but every school has their is developing their own plan to uh achieve the mission of culture proficiency and so some are going the route of ADL no place for hate some are going that is not a requirement that everybody does it right now everybody is working with their school teams coming up with their own culture proficiency plan and that's something that actually our our 3 student superintendents are working with the principles to look at what those plans are for their school recognizing it's not a cookie better approach but wanting every school to move forward with the work so I don't know if the 3 had any other insights as far as how the schools are developing those different options they're [Music] using I

163believe five out of our six comprehensive high schools are working with the ADL on some sort of implement of no place to ha and then s Hills is using utilizing Bridges which is a similar program and many of our middle schools I don't know how many I apologize have initiated work with the ADL or another grou SAR are those programs costing us anything for those I believe they are so I recall it was like a 5,000 I think it was like 5,000 person school um that covered it I could be wrong but we because we we okay it for the schools that last all right thank you there is a two a two-tiered approach though there is the no place for hate um there's designation which a lot of the elementary signed up to do

164and that is really that's not going through the full program it's doing a few activities in um conjunction with the adl's um lessons and it involves the student groups at the school so then they can be a no place for a designated school which is different than going through the entire um no place for curriculum with AO and is that in in addition to the culture proficiency lessons that we have approved and designed so it's not just you know one lesson every year at a certain grade level this the no place for the ADL is an addition to that it is an addition but they're more like activities so I don't know if I would classify them as a lesson the way that our cultural proficiency lessons are but they are more like activities that

165the students would participated and they're very age appropriate so thank youy ctios and then truste Jones um I was just gonna comment because Aliso Niguel just kicked off on Tuesday no place for hate and so one of the things that they did is that they created their cultural proficiency team at their high school and this was all last year when we were um in our hybrid and Co plan and um that team met once a month and then came up with ideas on how we wanted to tackle it at that site so they decided to implement no place for hate just because that's what the team came up with and it is correct it's three lessons throughout the year that you have to commit to and then the students um when they kick off the

166program they made a pledge this week that they were going to be uh commit to and the pledge is a series of statements about how they're going to create an inclusive environment and um commit themselves um to including all and it's it's it's a couple of statements that the students are introduced to the ASB is involved one of the things I do want to say about no place for hate is it's very student driven and it's student centered and so it really goes back to them and how they want to kind of develop the program at their site so it is very site specific and really focused on the students I guess my concern is based on some of the input I receiv received is it's not required right students don't have to their principal

167isn't going to say get detention if you don't sign colge no and actually at Aliso they just had banners out in the quad and as you're passing classes you could sign the pledge you could outline your hand you didn't have to put your name on the banner you could you could did not sign the banner it's not that anyone was watching you it was just out for everyone to participate if they chose because I got the impression from one parent who said they're keeping track of whether my kids signed or not and they're being intimidated one way or another I don't think that's what's going on so that's that's what are the lessons taking place in English class I think that depends on the site tutorial last year I think was in English um if

168I can add um Sarah Kang who is a San Clemente High School teacher uh sent me an email yesterday she's an English 3 and English 2 honors teacher and the Key Club advisor no place for hate coordinator she sent me um she's advocating for this cultural proficiency but they had shared with me that um they had signed um The Pledge they had about 300 students now they said they had fewer they had some kind of glitches because in the past they've had like 2,200 but um as the student gave their um email address and who their um I don't know if it's a home room it's a teacher's name but anyways they were asked to describe in one word how signing the pledge makes you feel and um so I read 300 different entries about

169about how the students felt so it's as simple as something like that um to evoke conversation and um I guess any school can decide what it is that they want on the pledge and that's something sanen just did uh recently so I wanted to share that yeah and also um I mean I don't know about all the other high schools but at SLE manyi we did it where like in front of like the library there's like a big poster that you could sign or like we also had like Google forms that like our um teachers like during tutorial like you can sign it it only took like a few minutes and it's like Anonymous it's not like an everyone's going to see the Google forms it's only for like um pretty sure miss King's Eyes

170Only I don't think anyone else got to see it so there's no way that like students couldn't be bullied about like not signing it or like there was no like pressurizing no one was like looking over a student's shoulder to see if they were signing it so it's completely like free of choice I think um just I will say something after you um one of the commenters I wanted to uh respond to the the the term no place for hate I I have to say I am not crazy about the the no place for hate name I think hate is a strong word and I think we should use it sparingly I hate the term no place for hate but you know I thought about this a little bit and what are you going to

171do say no place for lack of cultor proficiency it's it's unfortunate but uh it's but I think it's it's a term that is being used and I think kids figure out what the the um uh intent is when they're going through the curriculum uh and I wish it weren't called that but I'm really not sure what would we call it instead well we can't forget that we had what over around 850 testimonies from our students from all over past current um talking about hate and sometimes that is the word and in order to get action and to get the right direction we need to come to terms with ha a word um so I think um I think we could you know people want to wear that down to the N degree because they've got

172something else going on but back to the ADL um training I know that um just to uh Lisa and I at s Clen High School Chris Carter is very proud of the work it's uh it is very flexible it's user friendly it helps set that tone for the school um and um as uh Judy commented uh Miss Kang's um document that she sent us the the students one word thing was inspiring um these are young people willing to use really expressive words of what they're experiencing so super positive all of this work is is needed even for those of us go back and remember Saturday school and that's a case of obviously perhaps unconscious bias but when you look at a school when the demographics of a school are one way but everybody in Saturday

173school is another way we've got a problem so we're taking care of that and um I sometimes I wish my kids could go back to school I'm really excited about this work I know it'll be a long process and it'll take some folks longer than others and that includes our own staff um they've got a lot on their plate but I hope we can reaffirm to all of our schools who are engaging in all of this how how much we appreciate them doing this this is they've got a lot a lot going this is one more thing to do but in time it'll just be part and parcel and and this will change our school district to the better so thank you all for the for the work you're doing and I hope you can

174extend that to your busy teachers and your busy administrators um that this is so important I do wish it were to your point Ela I do wish it were cool to be kind I wish we could have taken that and stretched it because things like that are incredible and when we can put things in a positive light I think it helps teach children positive things rather than focus on something that's in in the title and that's hard not to when it's in the title I wanted to add just one more element to this um and it's all about engaging students um and it's all about hearing one another in the 300 words mostly positive I did notice two students in their one word one said confused another one said Angry so I wrote Sarah back

175and I said I hope one of you teachers then have reached out to those students to kind of inquire because that's not something I would expect to see on an inclusivity pledge so um these are the things we learned and these are the things that teachers you know will take on in terms of um having conversations where you know you get a bit of a vibe that maybe I need to touch Bas with that student see where they're at and all so it's all good stuff it's all you know about working with these kids so um thank you thank you so much for your work um so again this was just an information only item so we thank you so much and uh now we're on agenda number 32 and that is the board policy

1766161 .1 selection and evaluation of instructional materials or as someone like to say imrc um it's a first reading the board policy and I would like to recognize GRE mwin associate superintendent education sport services to present this item thank you very much president buus trustees superintendent the T Ral team we present to you item 32 first reading board policy 61611 selection and valuation of instructional materials so as we promised to trustees last spring staff has returned with revisions to this board policy to Define purpose improve transparency add Clarity to our instruction materials Review Committee process also known as the imrc but I would like to also take a moment to thank all of our current imrc members for their service and their patience during this revision process because we know this has been very challenging

177to make these revisions during during the school year and when new curriculum requests are pended so we know that this has been difficult we appreciate all of their patience and our uh the patience of our members so we know that this uh has been difficult we appreciate that we also like to point out that as standard of practice for our District staff presents the board policy which provides the framework and then staff will formalize more detailed procedures inside of an administrative regulation document Dr Carrie John son assistant superintendent curriculum instruction is also here and available for any questions and feedback thank you trustees we have three speakers on this item before we take questions and we may start with Bethany padila hi everyone um I'm speaking again but um just as a reminder I'm a

178senior from s Clin high school I'm also part of the no place for hate committee that we have been you guys have been discussing and a lead for s High School Against Racism um I will be speaking on behalf of our task force and basically the student body people I know who deeply value um the exploration of a diversified curriculum um speaking with other teachers different students from other campuses even my younger sibling who's in Middle School um our student body is super invested in exploring other perspectives and I just want to stress like stories like bless me Ultima and um another good one is Kite Runner those are great examples of novels that are already in place that are giving these students a great um just like a complex understanding of other voices than

179Shakespeare and Heming way like just usually um male white writers that we've been taught for most of our Lives um yeah I just want to say that this awareness to these other identities are building strong foundations of critical thinking skills for our Rising Generations like this is all about um adding not focusing on like this division focusing on any negative actions like we just want to add great perspectives and understandings of other cultures other languages that we are currently lacking in in our campus I will say though at s High School our teachers are doing such a great job in just diversifying our English departments especially so I think that's all I have to say and thank you guys Bethany if I may say thank you for hanging in here with us tonight throughout this

180whole meeting and we love to hear from students and um so we appreciate your your comments and now uh Michelle Campbell good evening superintendent Board of Trustees I appreciate seeing revisions to the imrc process that will highlight the input of our amazing Educators while actively working to remove the political from this committee texts recommended by our educators are reviewed for the contributions they make to our learning sometimes our learning material isn't fun or easy or makes our stomachs turn thinking of frog and Squid dissection here but they have value and purpose and teach systems so please be guided by the voices of our highly trained Educators and these changes are the first needed to start that process thank you very much and Jessica guy good evening superintendent president bolus trustees and Stu student adviser Pia

181thank you for revising are very important imrc process it is long overdue the most exciting part of the re revision is the flexibility to recruit teachers with expertise in that subject area to review materials after all they tend to be familiar with their subject matter and can give real life context to what the committee is reviewing and considering so thank you again for this re reboot of the imrc thank you and now do we have any questions from trustees I'll go ahead and jump I'd like to propose that we uh pass this on a first reading uh we can do that if we vote unanimously um and I think that would be helpful okay we have a motion to pass uh to excuse me to wave the second reading and I see a second okay

182and um room so it would have to be unanimous vot so you might want to wait good then I can make my comment okay is is that your understanding m t we could hold it to hear a comment I don't think I think that's correct but I do think it's important that you're all here if possible it'll only be a few minutes so so if we could just move to discussion for one minute and then come back to the vote so I do have some questions we could we do have a motion in a second so now we can discuss we just come back up uh so my question is um oh and by the way okay now I can't remember who said it maybe it was Jessica Guyer or who it was but whoever

183said um one of the great additions is having some of the professional when I was on the imrc is when we were passing the Mandarin program what do I know I can't I don't know mandr so I contacted my dear friend who is Chinese and had her Harvard because of coid Harvard student at home who had gone through many years of Chinese and all I said would you mind looking at this and just giving me some input um that resulted in some feedback that not only did we have excellent um the the textbook was excellent but rais the question and this goes back to when Josh Hill was here is but we noticed that the middle school are you she asked are you bringing in that textbook for middle school because this book is so

184good and compared to where her daughter went Irvine for her Chinese um that it would be important that our students from middle school would be able to then do this more advanced curriculum and so that question brought about so you know it helpful then to have the professionals come in and be able to um any kind of special and if it's textbook for you know certain electives or whatever so I did like that feature I did want to ask the number one point and I'm sorry if I don't really understand it it reads language for increased access to proposed materials by MRC language what does that mean the first word language for increased access I'm presid we is it the board report or I'm sorry under current consideration I see it's the first bullet point

185is language for increase but we changing the language we're improving the language I don't I didn't follow it so my re I think it's the what you were talking about more experts having Hands-On um I think one of the things we um go for with the AR as proposed you would have these ad hoc teams that you could put together that are experts if it's a specific novel or a specific type of textbook um to some more and all I'm sorry so those committees but also um more time for the public to see it and more time for the board to be aware of um the information so even though we would this under this current version there would not be board members on imrc they would still have access of if they choose to

186the materials for those 30 days plus the 30 days before the board actually acts on it does that make sense or you're explaining it does but the lead in sentence and therefore recommends the following revisions language for increased access to proposed materials by imrc members I don't think that really kind of explain the only answer I have for that is I was a history social science teacher instead of the language arts teacher and so that would be my fault it's it's language in the policy so it's a noun so it's the words in the polge language in the to provide for increased access I just think the sentence could be restructured to for better clarification okay I only have one more question and this was a bone that I picked when I was in on

187the mirc and have proudly been able to say my appointe has attended every year 100% of the meetings there's nothing in here but um and it might be within the you know expectations of review materials do we have any kind of expectation being expressed to our imrc committee um in attending the meetings and being that they are participating in the voting because we've had many issues with things in the past it only a handful had even voted sometimes it was only two or three so i' just like to know if we what are we saying and because I did see that unless it's the majority eight of this 11 person committee it has to pass by a minimum eight before it comes before the trustees but then how does that go back to you know

188telling them to attend these meetings and their participation so I'll I'll start and then Dr Johnson can can fill in but it's so in that administrative regulation in state that if if a an appointee cannot attend then there needs to be there would be immediate uh discussion to have that appointee temporarily replaced so we have language to say that we we expect participation by all of the board of appointees so that would be a very important part of the of the administrative regulation okay and I'm sorry I said that was my last question but I do have one more um so if we don't have any trustees on the committee and I think um superintendent B Roy would not mind my mentioning she was kind of surprised that we didn't all the imrc committee didn't

189or receive the book you had to come to the district So when you say we're going to have access will we seven trustees and not two Representatives will we receive the books or how is it that we're all going to be made aware of your books you're being considered I believe that was almost unanimous feedback from the trustees is that to have um access to we were going to be purchasing um copies of whatever of its novels or textbooks available for each trustee um to have access to absolutely in addition to thec M that's right and that's so that's the other part of the that adding language to increase access it's actual materials in everybody's hands that you know in the past it was let's pass around one copy now it's everyone has access to

190the material so that's the other part of that first bullet that I didn't want to add is that it's part of it it's then there's that materials are available for everyone and I love it thank you so much yes now trustee uh jnes and then truste Davis yeah I just have a quick question about that Dr mwin so um that's great for some stuff but if you're going to have French books for all of us I don't know uh you don't need to provide the calculist books for me um I you didn't need to provide them to me when I was in high school but um so I I think I think that that's not necessarily something we need to plan to do for everything um clearly for novels I think it's a wonderful idea

191for the supplemental material but um you know a lot of them know not so much and and and I don't know that even something that uh any trustee might enjoy reading uh for example let's let's take the AP Euro history I I no one's going to read the entire book well I'm sorry but I don't think anyone's going to read the entire book I mean I I would like to look at it but I don't need one for the whole month to look at so I I caution against us like buying so many copies that every single trustee has you know the German 4 book anyway unless we're going to get a subscription with paper and we get our own tutor to help us with the calculus books but anyways as you go through it's

192a a great point um so that maybe you can inquire how many you should order so trusty Jones I mean it's a great point so the issue is that one of the reasons we're adding on subcommittees and ad hoc teams is not everything recommended uh would make it um to the IRC right so those um instruction materials that make it to the irrc we would be purchasing I mean that's my thinking on this um that would be provided to Bo so yeah we wouldn't be purchasing every material uh that's recommended okay so I didn't I'm sorry I but that so I didn't understand something here what makes it and doesn't make it to the imrc what types of books do and don't so I think that would be something as we develop the uh the

193AR we would be make sure that we were clear about that next well and this is where this is the idea of the subc committee so recommendations and I appreciate some of the questions from trustees that as the board policy has written that Community students um may make recommendations for materials the sub committees would then receive those materials and those would be expert teachers and administrators looking at those closely and then they would move forward to the imrc and we will have a clear process on how the criteria for it to move forward but then that allows truly Community parents students to make recommendations but then it would be filtered through the subcommittees of the teacher experts and administrators Bes Davis so a couple things um one importance of attending attending an imrc member attending

194meetings and voting and reading the material actually reading the novels and maybe it's somewhere on the for that says that if you've had a chance to read it or not because it's hard to take a vote if you haven't read it especially novel I'm great I culous with M I read it cover cover um and then the importance of the initial meeting being presented by the teachers followed by a meeting for the imrc members to to actually have a discussion about what they're voting on I think that helps guide the direction of where they go and that's before the vote and I haven't had that experience with what I've been involved in this year but I think it might be an important piece and allowing did I already say this allowing enough time to read

195the material so for seven novels and to have it in two weeks is not not enough time for me it wasn't enough time for me so I was grateful for more time to finish reading the before before vote so trusty gave that's a great point so one of the things about the imrc is that it will be very much akin to a board meeting it'll be an open meeting it just like you would move in second a discussion and and then have the discussion the imrc would follow a very similar pattern so they would have the opportunity to discuss plus um in the IMR in the sorry the AR we will have a cycle with enough time built in when um instructional materials are recommended to when the actual iry has time to to between

196that time when they have time to read it vote on it so just one for more follow up am on that um and I really think that that the initial meeting we that's important the teachers need to present the material why how it fits where it fits in the guidelines and curriculum um standards and then there needs to be a follow-up meeting not at the vote but here's the meeting to discuss and go through and you know come up with some thoughts on it and then the follow meeting the last meeting to be the vote I just I'll be as quick as possible can chck um thank you um so I just want to revisit the integrity and intent of why we're revisiting the policy um and it was to De politicize as as much

197as we can the process and to um restore or or Elevate where where we really should have that professional voice the teacher's voice um as much as I'd love to give my opinion on everything it's not appropriate for me since I don't but I do trust the work and the process so I just want to make sure in this policy we're talking about all these people's fingers in the fire here I want to keep uh the focus on as as Lisa mentioned those teachers presenting they believe in this is what they need and there's a point where we have to recognize they need these materials to do their job and move their students forward and we all W to biger and but it's not our place to do that so I'm hoping this policy does

198affirm as it says in uh the overview that this does move this where it should be and that is these are our teachers and our professionals saying this is what we need and then um yes the imrc can discuss with needed and so on so forth but the time it gets to me and moves through that um and because I do believe in all of you and our teaching professionals I am usually very good to go if it's gone through I also happen to adore my imrc representative she's been doing it for years um and so I just want to kind of revisit that keep our Focus back on what the intent was why we were redoing this because it was getting all over the place so if everybody feels comfortable that we can move

199forward especially with your additional administrative regulations I I would go with G and move the item tonight so we have a motion on the table by trustee Jones and a second by trusty hanich to wave the second reading so I think we need to take action on that have comments I have another comment sorry trist asked for a vote so I wanted to reiterate was a second this just to be yeah I was going to explain it because um trusty Davis was out of the room and probably not aware that we have a motion there um so you want to take the vote and then I'll make my comment it's up to you I was just trying to um remind everyone there was a motion on the table okay on the floor go ahead so

200procedurally you could take a vote on waving your policy so that you could take action tonight then you could make a motion and second on the actual policy and then continue your comments on the policy and I would like to make a comment at that time if possible a motion in a second to wave the second reading all those in favor say I I any opposed so 70 vote and a favorable vote by student student adviser um can I you um so I really don't know what trustey Hanah is talking about political political um the politics of it but what I want to say is and ask um my concern is the teachers who come forward on these committees um sometimes we have committees and we have teachers that are very anxious to earn additional

201stiens and um reviewing these books takes a real commitment you know commitment of time and all and we have other um teachers that you know are it's not about the money but it's about making sure that we you know have good textbooks um so the frustration I have had is that when these votes had taken place and then I have have the teachers who were on the test pilot committee say oh yeah I can't believe that that book's GNA come through and then it's like well you know I kind of Wonder well who selected these teachers and it's you know sometimes we have a hard time getting teachers to volunteer to be on some of these committees that we think would be so good um and so quality of the teacher Forum um being able

202to make sure I mean I would love for us to reach out to principles and kind of get a thumbs up yeah this would be a really good person um in terms of being on the committee or if you if you've got a hot topic you know in terms of some novels that you've got different ones so that had been a concern of mine in terms of U the quality of the teacher wanting to do this work and now I'll turn it over to Super so somebody has to make a motion in a second on the actual policy of my question to Dr mwin is that all the feedback you received tonight it sounds like could go in the AR and you don't want have to make a you don't have to change the policy

203to be able to deal with those issues is that accurate that's correct that's why we're all actually separating them into the two documents okay so I just ask that the board make a motion and a second on the policy second okay moved by truste Jones and seconded by truste bronstein all those in favor say I I I any opposed at 70 vote with a um preferential vote of I from student adviser Pia thank you very much trustees president buus before we go on I that we have um uh in the audience Mr Keith Weaver who's here for item 34 could we take that before item 33 I meant to ask that last time and I forgot I think that would be really nice of us it's doesn't save too much time but does everybody agree

204let's do that go ahead okay let me at least call read out um in terms of 34 ahead of 33 excuse me resolution number 222-1 19 it's a resolution of the Board of Trustees of the cap Unified School District authorizing the issuance and not to exceed 10,00,000 aggregate principal amount of community facilities District number 25-1 that's Whispering Hills of the castron UN Side School District approving the execution and delivery of a second supplemental um enture and a refunding escrow agreement and a placement agent agreement and approving other matters related there too and this particular item has as much to it as that long title so help us get through it I'm going to recognize Clark Hamilton Hampton Deputy superintendent business support services who's probably then going to intro Kevin thank you so what you let

205out president this was a fancy way to say that we're going to refinance existing bonds and an issue have issue another small number of L is here with our financial advisor firm every Financial strategies the it good evening thank you for the time accommodation I certainly appreciate it so as Clark said I'm GNA talk briefly about W Spring Hill cfd and I have a brief overview of the cfd to share with you and um and then I'll discuss the um I'll discuss the refinancing item that CLK mentioned is our first item Then followed by Insurance of additional bonds which will give us some funding for school facilities and then we'll wrap it up with some uh some next steps so um if you can see here the map on the slides shows the shows the

206uh the boundary of the cfd there's 140 residential homes that are located within the boundary of the cfd it's located adjacent to sanan Hills High School and there's also 15 undeveloped custom Lots um just by way of History the cfd was formed in 2005 there's a couple of residential communities that were developed within the cfd and in 2013 we sh about 188 millionar of bonds followed that up in 2016 with about 12 and a half million of bonds and we have remaining authorization of about 9 million and so if you we're thinking about refinancing we look to interest rates this uh graph here showing a benchmark interest rate and you can see the interest rates were much higher in 2013 the index was at about 4 and a half% it's currently at about two and

207a qu% so interest rates are much lower today the signals it's a good time to think about refinancing and so the concept of the financing plan is that with refinancing we get to lower our payments and that gives us the opportunity issue additional bonds to help fund school facilities um so with refinancing our interest rate would be reduced from 5.39% down to 3% so a really nice interest rate reduction uh we end up saving $1.8 million on these prior bonds um in terms of thinking about is this a good amount of savings we look to gfoa best practices and based on that guideline we recommend uh Savings of at least 5% in refinance bonds the metric shows us at 177% uh the point being well above the minimum uh threshold uh for best practices and

208so it's a really good time to to be refinancing and then this chart here is showing the payments so we could uh reduce the the payments on the 2013 bonds that's going from green to Red uh we layer on top of that the the the 2016 bonds and that gives us room to then issue more bonds this year to help fund school facilities and this entire time we can stay within our our c tax revenue um so with this we could issue uh $1.45 million of bonds for facilities uh the interest rate here would be 2.4% and that would net us 1.37 million in proceeds to help find school facilities then I'll mention this would help supplement uh some uh funds on hand that we already have left over from last time about 2.1 million

209so in total we get to do about $3.5 Million worth of uh facilities projects so in thinking about our facilities projects the plan is to find some projects in ambul onary uh District staff has already walked the site talked to the principal about the needs and the thinking right now is to do some projects that include technology infrastructure uh fire alarm upgrades and floor and stealing improvements at the school and of course as is subject to budget and water approval my understanding the expectation is these facilities plans will come to the December meeting and so in terms of process we had a competitive proposal process among the short list of five banks based on their appetite for these types of bonds the best proposal came from a bank called First Foundation their local bank that

210based in herine and we will be borrowing $9.8 million in total to accomplish both the refinancing as well as the the facility funding um the interest rates have been locked and so with your approval will stay at these very same interest rates we don't have to worry about Rising rates or any volatility the interest rates will be fixed uh we do have the option to pay these mods up early or refinance them again down the road and they are repayable specifically from the CSD Revenue so we don't have to worry about encroaching our general fund or any of our other funding sources so tonight uh for your consideration we have a resolution that approves both refinancing as well as the new bonds for Ambu Elementary uh we proceed with First Foundation and work with staff

211to finalize the documents and then on November 6 we close at that point the district would have funds to both do the work in Ule as well as to accomplish the refinancing so thank you and happy to take any questions thank you we don't have any speakers on this item does anybody have any questions uh in regards to saving money truste mcnicholas um absolutely support the refinancing and ke is always on top of this um question I think more for Clark and the facilities folks uh are we are we bound to only use the funds for ual or is it uh our priority to use it for U or what what else could we do I mean is it are we limited be used for schools serve cfd so the idea is Rec ACC and

212atal operations on cus to do that okay did we did we not just spend money at anual as well what was the question did we not just spend some money upgr was whis it was also whispering okay wasn't that a little more cosmetic though in terms of the MPR modernization this is infrastructure and there's other this would not beu this would be some some more modation infrastructure what I said oh yes my recollection is that the cftd documents specifically call out Ambu alone may be wrong but that that's my recollection any other questions from trustees do we have a motion to adopt resolution number the uh we would be authorizing the issuance of a not to exceed 10,1 100,000 aggregate principal amount of community facilities District number 25-1 Whispering Hills um and approving the execution

213and delivery of a second supplemental indenture a refunding escro agreement and a placement agenda agreement and approving other materials related there to comment should we have a discussion about whether the money should go to you're you're not making that decision tonight so I do think what we would do is bring back that funding if in fact the board would like to consider putting it somewhere else anying will be future Bo so this would just be to refinance this is just to refinance not to deter and and when we make the motion we could just augment the motion to make sure that that's in the record that it's only to refinance and not to decide where the funds would be spent tonight yeah and if I could add to that so the resolution does ask us

214to approve the refinancing as well as the bonds for facilities but the facilities plan isn't coming back to the board until December so I think at the December meeting they'll be an opportunity to discuss do we spend that money in U or elsewhere but tonight it's just about making sure that we get funding in the first place move the item oh you want yeah I move the item to refinance okay we have a motion um by trustee Davis and a second by trustee Jones um all those in favor say I I any it's a resolution I'll follow the rules sry uh student adviser pod hi trusty brunstein hi trusty bulus hi castanas hi trusty Davis Hi trusty hanich I trusty Jones I trusty mcnicholas I motion carries 70 with a preferential vote of I from

215student advisor P thank you very much okay we're going to go back to item number 33 and that I think is the yes the board policy 5125 this is the second reading of Student Records we had it on our agenda October 20th and we had to push it to um this evening so I'd like to recognize Gregory mwin a our associate superintendent education Support Services to present this item tonight thank you president buus trustees send Bal Bry we present you item 33 second reading board policy 5125 Student Records we return tonight with edits and revisions in response to trusty feedback into September 15th 2021 board meeting Dr Carrie Johnson assistant superintendent curriculum instructions available for any questions and feedback on the second reading we recommend approval of board policy 5125 student rec thank [Music] you

216we do have one speaker Michelle plel Campbell good evening superintendent Board of Trustees I appreciate the bringing back of board policy 5125 Student Records what prompted this review was the requirement that districts now allow for name changes and gender identification change changes be made to Student Records of previous students what I cannot find in this policy is one a statement that this can happen and two how this happens I appreciate to create a clean policy items were stripped out to administrative regulations or ARS but these are not available for the public to see so how is a member of the public would one know that name and gender changes to the records is even possible second I like how the section on social media is drafted thank you very much preses do you have any

217questions in regards to the Student Records trusty Hannah yes could we please address the speaker um question thank you um absolutely so my understanding is that the public does have access to that administrative regulations or is that Inc correct from the past they've been stored for administrators got it okay so um usually this process in the past when I was a consan student records was when people reached out to the Student Records Department for their information they were given this um option whether was an application or advised of this process so I guess I don't know why all I see is the thing stricken out so I don't don't see anything in my phone um so basically policy or no policy we have a we have we have a mechanism with which we have it

218stated somewhere that that's their they're reaffirming what she brought up is just now a state you know law um so do we have that and do we need to put it in in this policy or in AR is some appear somewhere else in past experience it can be included in the AR um it doesn't need to be highlighted in the board policy um and just like the last policy once this is um approved by the board then we will develop the administrative regulations that coincide with the guidance issued by the trustees one way to handle this is also to have you know some kind of a form on our website with the information which then people just check off I am changing whatever it is right which then conforms with the law that we're going

219to follow okay however you do it yeah I mean I think that long as we have it somewhere in response to speakers concerning and that's what we did in my prior District was a for exactly like superintendent so I guess the question is whether we just want to put somewhere um you know that action that um [Music] superintendent or design should have a you know a form on the district website just so for transparency purposes I'm sure there's a perfect place to put you know such a phrase I guess my concern is if the reason one of the reasons we're updating it is because of this law but then we didn't say anything in the policy about what the law requires what was in the csba model policy was this the [Music] same yes this

220was then I guess we probably shouldn't have said we're doing this to compil law does it say in there that we're doing it well that one element is compliant to a law which is what prompted this the proposed divisions to this policy updates the policy number to be the ca policy and allies policy with current law and reflects CBA language so I don't know so at the beginning where it says collection retention security of Student Records I mean at that point it could just be a sentence saying you know directions for changing Student Records will be prominently placed on the district's website and that way it would be very clear where people would go to either find their record change their record whatever that may be and I think if a student had a question

221that would probably be the first place they go search is the website see if you know where they get information to do something in right but they're not going to be searching board policies the student parents are not going to be looking at board policies so it could be on a website right all about Student Records which is a more accessible and then a AA counselors train that this is where the information is because normally a student goes there right right to guidance right but I don't think that even an note about where you could change it belongs in the policy maybe in the AR but I you know I I don't see that as necessary for the policy um and no one's going to look for it there where they're going to look for

222it is on the website or in maybe a student handbook or whatever and and I think that we may want the flexibility to be putting it you know in various places and I don't think that enshrining it in a board policy is way to go I think the trusty direction is just to make it available and make people aware that it is available not so much concerned about where it is and what document am I correct absolutely I'm gonna Mo the item okay we have a motion to move the item by truste Jones do I have a second I'll second second by truste brunstein and all in favor say I I I any opposed I still have a question okay 70 vote with the preferential vote of I by student adviser pette with a question

223from trustee hich thank you just a clar point of clarification does ab71 um not only for current students but past students um so I I think I'm still struggling that I do want to see it in writing someplace along with um you know then on the website make it user friendly that part but I think we just should cover the spirit of ab71 I obviously don't know that much about this particular piece of legislation um but what I defer I think the superintendent was on the right path um with uh putting it somewhere because this is this is gonna stand you know for a while it's not going to come in and out so we'll put it in the minutes of the board that the expectation is that we put how to do this in

224prominent places clearly describing the law and then providing training to the appropriate staff to be able to um Point students and families in the right direction so we can mark that in the minutes so that it's super clear what has to happen next no okay and the last item of the evening is agenda item number 35 resolution number 222-226 and I'm going to recognize superintendent kirston theal Bry to present this right so this is a very simple resolution and allows us to continue our virtual meetings trustees to participate virtually when needed and our community to have the same ability so we need to compliance wise pass this resolution to be able to continue that and I recommend that we do that I think we have one speaker we have one speaker Michelle plel Campbell good

225evening superintendent Board of Trustees I really appreciate this resolution I find it a little little confusing though because in the second be it further resolved that having acknowledged prevalence of variance unvaccinated Mass compliance issues in the need to protect Health that under public participation the emphasis is on inperson rather than either inperson or via a virtual platform as Allowed by AB 361 many of our school Community now listen and participate remotely ending that ability is denying safe access to what is required to be open meetings please amend or revise the resolution to clarify to what the superintendent just said so that the public can participate remotely that the public can continue to participate via a virtual platform I greatly appreciate I appreciate what the superintendent said I appreciate how she supported I just don't think

226the words on the paper match what she said out loud and I hope they can be made to do so thank you not sure if the 25 copies in the back also made it online so there are a few and the whereas the last paragraph it says if a declared so declared is added at a at B at further resolved so I just want to make sure for transparency of our public that those words were added um we vetted this by our legal councel I know he's not here at this moment with this notion that we would be able to do all the things that I described so I can't answer for you based on you know the the um community members question but it is my understanding that it does allow for then virtual

227participation of the community and to my understanding is that the the reason for this is that the waiver of the brown act requirements regarding uh trust governing board members the board yes participating remotely without the requirements of posting where they are and notification all that sort so um I think the the for the public it it remains unchanged I don't think it would be my commitment that if it if we passed it tonight and it did not do that I think it's not a legal issue then I would bring it back with whatever information to change it but it is my understanding that really it's the trustees that's the major component of the law issue um do we need to do a formal amendment to add the words de Clare um I think we do

228because I'm I think there were 25 copies in the back and it was not uh I don't think it's posted in our District's website at that point that I would like to make an amendment to add the word declared in three places this is at the bottom of the first page I believe it's the seventh whereas paragraph 3 E3 insert the word declared before the word State of Emergency on paragraph a of page two insert insert the word declared before state of emergency and in the second resolv me be further resolved second line insert the word declared before state of emergency my reason for putting these in is because I want to make it clear that that we are reacting to the governor's de Declaration of a state of emergency this isn't us declaring the

229state of emergency so I appreciate the clarification and I think I might be answering our caller's um question is that um as you said it's mainly for us trustees and if we were traveling and called in and Provisions that we have to follow but we had discussed last year when we had to go and and do distance um that even if we didn't have a declared state of emergency we wouldn't walk away from the format of opening up telephonically because of the uh volume of teachers and community that now really participate in our school board meetings so we but has nothing to do with this item okay well I didn't know if that's what our caller was referring to in terms is what she was referring to but I think that but this is a

230yeah but what this is is allowing us to continue to suspend use the order that suspend portions of brown Act and the public participation is not a brown act issue it's our needing to appear in person or give prior notice Etc that is part of the brown act so there are public participation right this this yes okay I made a motion I'm waiting for second I will second so prar need to vote on the amendment first and then the motion is okay do we want col so try Davis second and do we want Colleen to read exactly how many different um changes we're making where we're in uh including the declare do you have that I think because um trusty mcnicholas read it into the record we would use that as the record and then

231she made her motion with those and it was seconded okay so it was moved by who was it moved by I I okay by trusty mcnicholas seconded by trusty Davis um and so now we need a roll call vote trustee hanich hi truste brunstein hi trusty Davis Hi trusty mcnicholas hi student adviser podia hi trusty Jones hi trusty casos hi I chrusty bullus I motion passes 70 with a preferential vote of I from student adviser Pia I now move to approve resolution 2122 d22 continuing authority to hold virtual meetings pursuant to assembly Bill 361 motion by trustee mcnicholas do I have a second second second did by trustee Davis all those in favor say I I I oh it's a resolution sorry roll call student advisor Padia trusty brunstein hi trusty bulz I trusty castanos

232hi trusty Davis I trusty hanich I trusty Jones I trusty mcnicholas I 70 with a preferential vote of I from student adviser Pia there being no further business before the board may I have a motion to adjourn to adjourn motion to move by truste mcnicholas seconded by truste Davis all those in favor say I I anyone opposed no it passes 70 the time is now 10:34 pm
