this become a position that we will have to pay down the road like the one a couple months ago being there it's a club it's a club it's not a well we had a club that turned into a sport well but he this is to promote like it would be track and cross country correct we already have traffic i guess my question is that's what happened in the past and i was wondering if this is the plan that that's going to be well i i would suggest that any of the varsity coaches like coach dalton myself when i was doing golf uh it's it's not on some any of the sports i mean it's it's become a year-round thing the kids can show up do it and we don't get paid any extra for that

he's getting paid as he's being compensated as a cross-country coach it's just going to be i would suggest that it's more of an extension of what he's already doing no additional costs right we never yeah we've never gotten paid thanks dave i appreciate it all those in favor say aye aye aye opposed motion carries need a motion to approve the bonding amounts for district real estate tax collectors for 2022 is presented second questions all those in favor say aye opposed commission carries need a motion to authorize the administration to pay the december 2021 invoices that may come due prior to the january 2022 regular meeting of the board any questions all those in favor say aye opposed motion carries need a motion to approve the revision to resolutions 2020 2021 number seven and number eight

general obligation bonds 2021. any questions all those in favor say aye proposed motion carries need a motion to approve kelly generator and equipment of pennsylvania and west virginia retroactive to december 3rd 2021 to repair the middle high school emergency generator in the amount of twenty one thousand dollars and thirty nine cents as presented so moved okay questions all those in favor say aye opposed motion carries need a motion to approve resource technologies corporation to provide professional consulting services relating to the console real estate tax appeal with the rates as presented questions this is so we can try to get some of that 550 thousand dollars back right yes um all those in favor say aye opposed motion carries you need a motion to approve payment to andrews and price for the invoice dated november 24th

0182021 and the amount of 11 347.25 as submitted so moved thank you any questions all those in favor say aye opposed motion carries there's the cafeteria report for the month of november questions on that we just go through them right yeah we don't have to have that's right correct solicitors report i have no uh report tonight miss jackson public comment on nine agenda items so just keep in mind non-agenda so nothing that's been already discussed on the agenda okay oh just a five minute one right this is the one that got changed to five minutes i would certainly entertain readjusting that if so somebody would want a motion to go back to the seven minutes or something else i would entertain that okay i make a measurement go back to seven minutes anybody get a

second to that okay good size for lack of seconds so it is at five minutes mr president we have seven in-house starting with sharon laffey good evening my name is sharon laffey i am the home and school visitor for the mcguffey school district i have been in that position since 2004 and i live in buffalo township i am here speaking for myself however i can tell you there are other staff members who are in agreement with me i wanted to speak tonight to make you aware that i am not in agreement with some of the things that are said and that are decided upon at the school board meetings most recently last month it was decided that there will not be a covet 19 booster clinic for staff members thank you mr leisure for voting

for it i was never asked my opinion about this we are professional adults and should have a say in decisions concerning us i listen to the arguments against the clinic and disagree with them all one reason given is that it is in violation of the health and safety plan because the health and safety plan states when requests were requested provide brochures and other information to staff and students about receiving any type of vaccination at sites outside of the district i do not interpret that to mean that a covet 19 booster clinic in the building is prohibited i do i would be interested at some point to hear if the district solicitor interprets it as such in fact in that same row in the left column of the health and safety plan which is entitled efforts

to provide vaccinations to school communities there is a hyperlink which lists as number one in that effort quote set up a covet 19 vaccination clinic at your school end quote it gives school located vaccination clinic success stories another reason given was a concern about possible side effects of the booster clearly it's mine and any other adult's decision if they want to take that chance we can get the booster elsewhere yes we can and i did over a month ago but there are staff members who need to get home to children who work outside of their outside of their time in the building who for many reasons would appreciate the simple convenience of getting the booster in the building where they work and we have health offices on the premises to accommodate that i suppose staff

members could take the day off to get the booster elsewhere but as you know we're very short on substitutes staff members who don't want to get the booster will feel intimidated or bullied to get the booster not everyone wants to get the booster but i trust that only adult staff members who want to would do so there was a concern about students accidentally being given the booster i try very hard to imagine a scenario in which that could occur and frankly it's an unreasonable suggestion someone mentioned becoming a zombie due to the vaccine while that comment may elicit a chuckle mcguffey was ridiculed in the observer reporter last weekend because of it and overall criticized for voting the clinic down we are not a medical facility was stated more than once no clearly we are

not however i was trained to use an epipen and was certified in cpr in the building i have received the flu shot in the building and have appreciated the opportunity to do so the fact is we are more than a school we provide food for those who need it and gifts at christmas time we are and should be a community resource and i think that is one of the best things about mcguffey i found it uplifting when the district provided meals for families while we were remote due to the pandemic in order to justify not having a booster clinic it was suggested that we no longer give the flu shot to staff members or have the fundraising blood drives that the students participate in i think that's a shame sure students can go elsewhere to

donate blood but isn't it better when it's done in our building students together with other students as community members selflessly giving to help others in need this has been a challenging sometimes overwhelming time i have admiration for the teachers who do their best for the students every day they've had to be flexible creative and resourceful same for the school counselors school psychologists and the school social worker as for debbie butterfield and karen ealy the school nurses i work closely with both of them and i am in awe what they do every day i would challenge anyone to be in their shoes for an hour i would prefer to be more physically protected and less physically exposed to possible infection than we are as it is we have a mask mandate which allows for medical waivers

without medical documentation moving forward i ask that you consider us the staff who are in the buildings every day when you make decisions that affect us thank you thank you thank you thank you number two teresa coppola teresa coppola south franklin township at the last school board meeting i stated that i would be preparing a thorough statement to address the repeated issue with mr leisure trying to suppress and stifle the first amendment right to freedom of speech i will be citing a recent federal district court ruling as well as constitutional case law from a landmark and unanimous supreme court ruling on wednesday november 17 just one day before last month's school board meeting were once again board member and then vice president mr ken leisure with disrespect toward myself and other members of our community

and with a flagrant disregard for our first amendment right to free unrestrained and unencumbered speech federal district judge gene pratter in philadelphia ordered a pennsylvania school board to allow parents and community members to criticize school policies and officials by name at public meetings the court cited abundant evidence in its opinion that the pensbury school board had abused policies governing speech at meetings to discriminate against speakers based on their viewpoints this ruling is an important step towards holding school boards everywhere accountable for their treatment of parents and citizens during public comment periods public speech at school board meetings is in fact protected by the first amendment wrote judge prater the court's order prohibits the school board from enforcing restrictions on speech at public meetings including bans on speech deemed quote personally directed personal attacks abusive verbally

abusive irrelevant disruptive offensive inappropriate or otherwise inappropriate some backstory pensbury school board was challenged in october in a federal lawsuit brought by four parents and community members who were repeatedly censored at school board meetings a video of pensbury's censorship went viral this summer showing community members being silenced simply for raising arguments that board members disagreed with during one public meeting held on may 20 pennsbury's assistant solicitor repeatedly interrupted residents who raised concerns about a new district policy while school school boards may terminate comments that exceed the allotted time limit they may not censor speech based on viewpoint the school board was accused of selectively enforcing its ban on personally directed comments allowing praise but banning criticism judge prater found ample evidence of selective enforcement when their case went to trial those who expressed support for

a decision or board member were welcomed but those who criticized the decision were cut off this is viewpoint discrimination wrote judge pratter while pennsbury's censorship of parents is shocking its policies restricting speech at public meetings are common in pa and elsewhere the parents and community members were represented in this case by attorneys from the institute for free speech which is a non-partisan first amendment advocacy group quoting alan gura who is the vice president for litigation at the institute for free speech pensbury officials are trampling on the first amendment rights of parents and residents to speak their minds about their schools they have cut off parents in the middle of their sentences yelled over critics to prevent them from being heard and intimidated speakers it is unquestionable that criticism of school officials and employees school rules

and regulations budgets and curriculum are apropos to the business of school boards regardless of whether school board members want to hear such criticism or believe it's fair the first amendment prohibits the exclusion of these viewpoints from public speech at board leagues this lawsuit serves as a valuable civics lesson for american public schools school boards promoting censorship are not above the law when government officials strive to silence first amendment rights of american citizens those officials can be held liable in federal court americans have the right to express their views about local schools and their leaders at public meetings without interruption elected officials including school board members must be able to tolerate criticism and dissent and most of all they must respect the first amendment rights of the communities that they serve today's ruling is a wake-up

call for school boards across america we encourage americans who have been silenced by schools to contact us for help and i have their contact information if anyone would want it now according supreme court 1964 case new york times versus sullivan our justices wrote this nation is founded on the profound national commitment to the principle that debate on public issues shall be uninhibited robust and wide open and that it may well include vehement caustic and sometimes unpleasantly sharp attacks on government and public officials end quote that is constitutional law in this country we have a god-given constitutionally protected right to critique you and we can speak in any lawful tone that we see fit in conclusion i'd just like to add i'm very excited that we're advertising for a new solicitor i believe one of the

most important criteria they'll need to meet will be that they defend and protect our constitution and be quick to advise mr leisure and the rest of our board that violating our first amendment rights is an action they ought to reconsider and refrain from at all future meetings thank you thank you good evening again monique fry morris township i have now two non-agenda items um my first one is in regards to the critical race theory um i know it's been banned in mcguffy um but it's recently been brought to my attention that their in the near future could be committees um put together to define what critical race theory is in um in in education um critical race theory doesn't belong in education period um when when i spoke last month about the great gatsby um

problem that i had stumbled across on the ixl platform it gave a question and then some answers to choose from they were suggestive um the one that was concerning to me is the quotation says they were careless people tom and daisy they smashed up things and creatures and then retreated back into their money and let other people clean up the mess the suggestive answer to match that quote is wealth and privilege protect some people from the results of their actions the actual quote from the book is they were careless people tom and daisy they smashed up things and creatures and then retreated back into their money or their vast carelessness or whatever it was that kept them together and let other people clean up the mess they had made some mates say says the same

thing but different i diff i beg to differ a reader is supposed to read something and come up with their own conclusion as to what that message is that's one of the awesome things about reading anybody can read a book and come up with a different message um the message that's guided here is the privilege message that is a direct line to that critical race theory that we are that we've already banned in mcgathey critical race theory has no place in education children should not be taught that they because they have one thing that they're better off every student has the opportunity to excel every single student in america and if we start teaching them that because they're privileged because they have money or they're privileged because of the color of their skin or their

privilege because they have a blue bike instead of a red bike or whatever it may be it leads to a whole ton of psychological problems that stem from that and stem even further out so in regards to that and in regards to any kind of committee i don't believe there should be a committee that defines critical race theory critical race theory just doesn't belong here and if there is such a committee formed i would like to be on it my second non-agenda item is in reference to the one of the previous speakers i'll just read some quotes two actually this one is from pittsburgh npr news station state lawmakers pushing new legislation in hopes to giving more teens access to coven 19 vaccines state rep dan frankel squirrel hill proposed a bill that would allow

kids ages 14 and older to get any federally approved vaccine including the coven 19 vaccine to say that that are our fears of our kids getting a vaccination without our permission um when there's already proof all around us that that is absolutely being pushed and fought for all across america and especially here in our own state just a few miles away it says a lot about you that's all i gotta say thank you thank you thank you number four vicky jordan vicki jordan buffalo township i wasn't going to do a follow-up but i think you all made the right decision in regard to the vaccine clinic to state that a teacher would have to take a full day off to get a vaccine is ridiculous i'm sure they're not taking the whole day off at

school i'm sure they're not leaving their classroom for longer than it takes to get a shot you all know how long it takes there's pharmacies everywhere we've discussed this thoroughly so i want to say thank you for making the ruling you did and i hope you stick with it thank you thank you katie moore uh katie morris south franklin township this is in regards to our facility usage policy for the community and for the new members on the board that may not know i'm going to rewind a little bit and remind you back in july 29th there was a meeting miss jackson discussed community concerns with vaccine clinics being held at mcguffy she specified that clinics should be brought up for a vote and this shingle added that the board should be informed on what

is being held at the school ms jackson gave her opinion on that no vaccines should be given on property on school property not just coveted and specified public discourse should be heard at the august 29th meeting a revision to policy 707 was read by dr lucas of andrews and price he added one sentence to the current policy and i quote the use of school facilities for any activity or clinic involving health or medical matters other than district related athletic physicals and health screenings compelled by state law shall be pre-approved by the board on september 16th the board and that was the first read september 16th the board motion to pass the facility usage policy as presented with eight eyes and one nil so again september 16th our facility usage policy policy number 707 was updated

almost unanimously given this information there was a flu shot clinic held at the school for faculty this clinic was brought up to the board for a vote was not i'm sorry the clinic was not brought up to the board for a vote and there was no public discourse this was approved by dr oberg and the excuse was this is always offered in the fall however we had a chance a change to our facility usage policy on september 16th and you are made of the controversy during the july 29th meeting so this was no secret we the community are holding you accountable to the policies so i have a few questions when was the flu vaccine clinic held at mcguffy was it after september 16th was it before september 16th that would be vital information i

have not been able to retrieve it the other issue with this facility usage policy who is updating these policies that are voted on by the board because they are not being updated on the board docs exhibit a and exhibit b so we have november 18th which was our last board meeting we have our usual board dock right here and as you can see mr ross there is nothing here that says last revised is that correct yes so the next day that was printed at 11 22 a.m on the day of the meeting 11 18. when we brought up to on for discussion and why was the facility usage policy and and this is up for discussion and debate if it was violated with the flu shot clinic it was updated 11 19 8 54 a.m

mr ross your assistance please last revised september 16th okay but it wasn't on this one so who updated it in the middle of the night and realized we didn't do our job there so that needs to be um there needs to be some accountability there um and you'll hear also there's that's not the only thing that's not being updated the health and safety plan has yet to be updated from i don't remember what meeting that was but justin will take it away on that so those are my questions one was the flu shot clinic why wasn't it brought up for board discussion it clearly states in our 707 policy uh use facility usage policy that should be brought up for a board vote discussion and the public should be made aware of it whether it's

for faculty or for students or both it needs to be brought to the board's attention and i think that's all i have thank you for your attention thank you for your time welcome the new members sony congratulations congratulations to you too mr thank you i'm justin good from south franklin i said a couple topics first um you know congratulate the new school board members i really appreciate how you voted for advertising for a new solicitor so thank you for that congratulations zoney i like the position that you're in thank you for fighting so hard for the community and mr haynes congratulations on the vice president so i guess there's just a couple things um i just want to talk about uh the sovereignty excuse me oh the gum the sovereignty of the board i just

want you guys to know that you truly have a lot of authority and to let other individuals out who previously spoke a mandate still isn't a law congress never passed anything the legislator never passed anything it's up in which how the board votes and implements the things that are given from the pa department of health and education so you guys get to dictate how mcguffey has ran and i certainly would love to have that health and safety plan updated so that there is zero confusion so that everybody knows black and white so we don't have to um have a legal opinion because it's so skewed and gray we need it we need to make it black and white when it comes to the vaccine clinics so um an individual gave public comment about having individuals

that she's not alone when it comes to wanting the coveted vaccine clinics and it just struck my memory that i believe it was either ross or somebody else on the board that asked dr oberg a question that said was there staff that reached out to you and how many has reached out to you and i believe the recording had dr oberg said zero so it's either dr oberg is lying or somebody out there is lying because something isn't adding up there so there's an inconsistency and i wanted to clarify that for the public so that they are fully aware they can go back to excuse me the last school board meeting to hear dr oberg state that um i believe at least whenever it comes to what monique frey was suggesting about crt i think

we need something a little bit stronger than a resolution zoney i don't know if we could implement a policy that would better accommodate the public to have a little bit more weight at least whenever it comes to accommodating a little bit more strong force when it comes to the administration of the school district to have zero confusion when it comes to what the public would want their kids to be educated because again um these students belong to the the parents and not the teachers not the administration i know that you guys represent us but they certainly do not belong to you either they're still our kids we get to dictate what's implemented and i really want to stress it for the board is you have a huge amount of influence of how you vote and

certainly the state isn't going to come after you so speaking about this the state it's concerning me because i do talk to several other school districts and i'm really connected with butler area school district so i'm not completely in the dark of what the pa department of health and education has been sending the superintendents and the district and what concerns me is i am [Music] very very certain that the school board isn't fully aware of what's coming in to the school district about what's coming in from the state i i feel that there needs to be a little bit more transparency and i don't know who would be able to implement that or if somebody can kind of vet at least on the board to make sure that they are overseeing what's coming in by

the pa department of health and education i don't know if there could be a policy implemented where maybe a president or a vice president can oversee what comes in from the state because the last right to know i believe there's two that i have to seek counsel about let's just say narrowing the scope of the exchange between the state and the district when it comes to governor wolf and all of the mandates and everything and everything that they're trying to push on these school districts my concern is i'm feeling that they're overstepping their boundaries and threatening uh possibly superintendents to try to implement um their requests for health and safety plans that still aren't law and they're advising at least the superintendent to somewhat oversee the board by breaking their own policies so policies are

very important we need to uphold the law we need to make sure that we are abiding by the law in school code policy is policy and it is quite evident that we've been breaking policy when it deals with the health and safety plan so hopefully we can kind of create some policies tonight or at least discuss some of these things so that we can kind of clear up any confusion i appreciate your time thank you so much that's the last for in person okay good evening i am chrissy florian i am from the east findlay borough um i want to start off with thanking the new board members for standing up and having the confidence and bravery to do what you're about to be doing um i appreciate you welcome and um congratulations to you

zoney for your new position on the board you also mr haines i want to thank you all for all you've done and continue to do i look forward to the good that you will bring to our school on the second note i want to say that your medical choices should not have anything to do with our school and be around our children you are here to teach not to be convenienced with your medical choices keep it out of our schools people are literally bribing children in other states with pizza and getting the children vaccinated without the parents consent so this is it's disgusting what it has come down to and this is why we fight so strongly to keep it out of our schools not that any of you would do that but it is

a parent's choice no one else's it should never be anyone else's choice but the parent or guardian of a child and we don't want it around our children another thing this is for the staff members for any staff member member or anyone with affiliations to our school that has made decisions or said things that i'm concerned about i've expressed different concerns in the past and they are echoed through other community members as well with some staff the inability to cooperate and work honestly productively and smoothly with the community and with a board member has and will continue to affect the district negative negatively if things are left unresolved um dr oberg thank you for putting uh the solicitor to hire another solicitor on the agenda after we wanted it last month and thank you to

those who voted yes for the new solicitor we will continue to ask those questions until solutions are made we will bring these matters to the eyes of the community this is not just false accusations these are matters residents of the district have concerns with staff not willing to go by the rules making up nonsense excuses to delay things to be done changes are being made mcguffy is in for a change we are watching it happen right now i want mcguffey to be the school that everyone wants a choice um make makes here on these grounds i want people to want their children to be educated in mcguffy i i moved here back here i was gonna move to uniontown i i got outbid but there's a reason and this is my hometown this is where

i was born and i went to school and i wanted my children in this school and like i had said before the first year of buying my new home in this district i had to homeschool them so i wasn't even able to send my kids to my preferred school choice thank you mask mandates this i want mcguffy to be the place that everyone wants to work and send their children mcguffy should be fully trusted with everyone's child and should be a safe place when parents hear that people in the school are making some of the highest wages are practically declining requests and concerns from the residents that is very frustrating i think that we've seen in our world right now what is going on is a lot of people that make a lot more money

than us average people have a lot of say in what happens all the policies the different decisions you know that are made i it's saddening that the people higher up the elite are making these decisions and expecting people that are higher up in schools to follow and then they give you ultimatums or they threaten you i would just like to say don't be scared and do the right thing because you can never be wrong doing the right thing so just keep that in mind when that does happen because like we've said before we have your back we have all of your backs if you're doing the right thing we've begged you so many times do the right thing get these masks off there's no mandate for adults out in public i understand if you're scared

go for it but get them off these kids it's been proven that it messes up their iq and not only that but everything so i mean [Music] we do have five people in attendance online if anybody would like to make public comment on non-agenda items at this point please use the raised hand function this is jackson there is nobody with their hands raised at this point thank you and that closes public comments uh before you continue i would like to um make a comment or ask a request i would like to see this is what i would i'm proposing that i would like to see this on the next month's agenda the information about penn commercials partnering with us and the reason that i would like it on next month's agenda i really would like

to get that in place we have seniors that would benefit they could get their cdl by the time they graduate and there's a great need for those people i really think you know we've postponed it we put it off and i really would like to see that on the agenda something that we can vote on something for us to look at for next month's agenda thank you anyone else western area career and technology center report we have a meeting next month next week the 15th uh we haven't had a meeting since the last time we reported because we're in between we're not in the third thursday right now do you say the 16th 15th whatever wednesday it is the 15th i believe that's the date pennsylvania school board association report i'm going to go ahead

and do that tonight since i was prepared to do that for tonight um they've been busy busy busy busy signed by the governor the caesar seizure training has been passed so now act 84 of 2021 provides that school nurses and other professional employees may complete online or in person caesar man seizure management training approved by the department of health beginning in the 22-23 school year also signed by the governor the veteran and first responder recognition days now act 87 of 2021 designates march 6 of each year as persian gulf war veterans day october 7th of each year as global war on terrorism veterans day and september 27th as first responders day act 87 requires the governor to issue a proclamation annually encouraging all public schools to observe these days and conduct exercises regard recognizing the

contributions of all those involved the proclamation may not mandate a public school to participate in the observance but they are encouraged to look at programming to support those things the independent regulatory review commission has this is concerning um all of the charter school reform so they have asked pde to explain and clarify numerous provisions with most focusing on the language regarding charter applications random selection policies audits the redirection process and healthcare benefits pde will get those responses to them they will then look over that and evaluate it um and then it continues to move forward but progress is being made it's just been kind of slow in the process so passed by the house i thought this was an interesting one for our area passed by the house hasn't been passed by the whole general

assembly yet but the house passed house bill 122 the driving farm equipment to aggie vented schools which would exempt tractors and similar farm equipment from vehicle registration requirements if they are driven to an agriculture related educational event hosted by a school less than 25 miles away students ages 14 and older they operate the equipment on the way to and from school and so if that's something that you'd be in support of you should call your state legislators and let them know that you want them to move out ahead it's kind of like the kids driving their tractors on the last day exactly exactly i think it was just more to make it official yeah passed by the house education committee um and this one is one that i've been watching um this has been an

area of debate in education for a long time but teacher religious garb senate bill 247 is trying to repeal sections of excuse me section 1112 of the school code which would prohibit teachers and certain other pennsylvania public school professional employees from wearing religious dress marx garb emblems or insignia while performing their duties in public schools the section is no longer relevant since it is not compliant with the 2003 federal court decision so it's kind of trying to clean up and make it um to agree with the federal court decision and that's been a really long time coming obviously senate bill 787 is called the open campus initiative this one really interests me i've been watching i've been talking to some of the state legislators about this particular one this would amend the school code to

allow the intermediate units um career and technology centers charter schools cyber charter schools all of that to enter into agreements with school districts to establish what's called an open campus initiative it's like a cooperative agreement between school districts that allow students to participate in courses not currently available in the resident school district and receive credit for that course if you're interested in more information i can give that to you passed by the house state government committee was a labor union reform package um that's like a whole slew of things but covering employee privacy public notice prior to signing collective partnering agreements termination of union membership recertification of union representation fair share fees and janus rights prohibiting political contributions through payroll again in the early stages it was passed by the house state government committee we

go to the full house and go from there and then passed by the house health committee uh specifically members of the community may be interested so that you can talk with your representatives about how you feel house bill 2013 right to refuse medical procedures proposes a new section to the pennsylvania constitution stating the right of an individual to refuse any medical procedure shall not be questioned or interfered with in any manner equality of rights under the law shall not be denied or abridged to any person because of the exercise of the right the other one um for the community especially if you're interested house bill 2077 which is they are calling the exemption from covet 19 vaccination requirement would permit except as otherwise provided under federal law a private or governmental entity or place of

public accommodation to exempt a person from the covet 19 vaccine requirement if the individual furnishes certain types of proof um but those are things to keep abreast of and school funding trial continues if anybody's been watching that or following that and that's just a lot going on there yeah um and then finally uh december 8th oh there is a webinar this is for the board in particular or school personnel but december 8 passed oh that's right sorry never mind never mind that was yesterday yeah so this is what happens when you prepare ahead you're like oh december 8th okay sorry i apologize then anyway that is all i have all those in favor say aye aye is there anyone to post motion carries i got the motion carries and uh yeah i had a near

temperature did you do the webinar did anybody know about it what was
