0056 pm at Pembroke middle school and that is all for this North Bend news update be sure to check out youtube.com mptv for all of our programming and more for North Penn television I'm Audrey Keller have a great night thank you Mr Gilmer next up we will have our Northland High School student Spotlight all happened Saturday night at a bar near the campus of Mercyhurst University in Erie Pennsylvania that was not part of our program so something tells me that wasn't Mr Gomer's fault all right good evening everyone and thank you Mrs Stoll so as we've been doing as we move our board meetings around to multiple municipalities throughout the year this is our first meeting here in town Manson Township and it is only fitting that we highlight the school right around the corner
006North Penn High School so this evening we have Mr Hassler our high school principal our coaches of our unified battery and track teams and then some very special student athletes so our coaches are Mrs Susan ahart Mrs Kerry Burns and Mr Jimmy Gruff um and of course I already said Bocce and unified and then our first student speaker they will introduce one another is Nick lupinacci he's a senior at the high school good evening Nick thank you for inviting us to speak at tonight's meeting my name is Nick lupinacci I am a senior and I've participated in Unified sports for the past three years Unified sports is an organization that provides opportunities for people with intellectual and physical disabilities to play sports alongside people without disabilities here at North Bend we participate in unified Bocce
007and unified track during covid we did a virtual unified heptathlon instead of bocce and Shrek my favorite part of Unified sports is that all the athletes and partners contribute equally to the goals and success of the team I feel like Unified sports has helped me develop my leadership skills because I was fortunate enough to be named one of the bocce team captains I feel like Unified sports is good for North Penn High School because it allows us to meet students that we might not have met in other school settings and we recognize the things that we all have in common a love for sports a love of competition and desire to help each other succeed thank you next we'll have Luke Williams speak so hi I'm Luke Williams I'm also a senior at North Penn
008High School this year too um so last year I started uh unified Bocce and then I just switched from here to unified trash and um so my favorite thing about Special Olympics club and Unified sports is how they include people with disabilities and without disabilities why I joined uh Special Olympics in Unified sports is because you know to make new friends to know to keep myself busy and then uh to get to do things like the Polar Plunge go on super trips and then uh also do the uh Penn rear lasers too last year so um and then play Bocce and run trap with my friends why is saying Special Olympics is good to join is because um it gives students who don't give a fair shot to do anything a favorite shot to participate
009in something and uh uh what special Olympic does it North Penn is we um plan to include everyone uh playing uh playing field trips to make posters around the school to let everyone know what we do and what our mission is and how we uh how you can hold an officer officer position and special Olympus club and how to become a Captain on our Unified sports teams is by like putting yourself out there that's it okay hi everybody my name is my name is Sofia I I run for if I trust in living glitter and this year happy party and I'm running track I enjoy a lot of sports but I love tracks the best because I like making friends I like to run really fast and this year I want to do my favorite
010part is to reverse Sports is that I get to hang out with my friends Megan is like why in Israel I know I have known me in since the second grader I like to be able to see them after school and you work week and we talked again at Josh too next is Emma bye hi I'm Emma Hirsch and I'm a junior at North Penn and I've been doing Bocce and track last year and this year and to me Unified sports allow us to all come together as friends and share common interests unified has done so much for me it has allowed me to build some of the best friendships with people I may not have met if it wasn't for unified it has also helped me to realize what I wanted to do with
011my career in the future and has also made me more social in and out of school I think Unified sports has also had a huge impact on our school by making it a very welcoming place and allowing us all to be friends no matter what our differences are and if you guys want to come to our first track meet on April 14th you're all welcome to come all right well I just want to thank all of you for being here uh especially the student athletes I heard a common trend of friendship and working together to accomplish your goals and I just really appreciate you guys being here and celebrating one another I also appreciate the coaches all the time and effort you put forth to these amazing kids this is what it's all about so
012thank you for coming and to the parents in the audience for these wonderful young men and women thank you we appreciate you coming have a nice evening and while they are exiting I did fail to thank Tomlinson Township for having us this evening we have some folks go ahead guys bye foreign we appreciate your generosity in letting us utilize this beautiful boardroom I've actually never been in this room um it is gorgeous and we also want to thank uh Lieutenant who's in the back row uh congratulations on your promotion and thank you for all your episodes yes I think we want to recognize comments and advisor no Joyce Snyder here tonight too thank you thanks for letting us use your disability that was really nice okay um next up we'll have the audience of citizens
013so I'm just going to read off this uh public comment um statement first and then we will have our two pre-registered people speak first uh the first was Mrs Altieri and the second pre-registration was Mrs broccio so this meeting is being videotaped for Community cable channels and streamed live individuals attending this meeting and intending to speak to the board should be aware that they are being videotaped in order to meet the requirements of Pennsylvania Sunshine Law it is necessary to report the names of all citizens who speak to the board during the meeting the short compliance with this requirement it is essential that those planning to address the board State their name and municipality members of the audience are asked to limit their questions and comments to three minutes as a reminder the audience of
014citizens portion of the meeting is designed for residents and taxpayers of the district to provide comment or feedback on matters which are or may come before the board it is not designed for debate when appropriate individual School Board directors may choose to respond to public comments that have been made once the audience's citizens period has concluded and this is in reference to board policy so Mrs Stolt uh given that we only have two pre-registered speakers I just have a suspicion we have two individuals in the front row that have a prepared speech do either of the pre-registered speakers mind if the kids speak first okay go ahead guys go ahead guys thank you so much thank you go ahead to Dr Bauer and the members of the school board hi my name is Ryan kolp
015I'm a sixth grade student at Englewood Elementary School and tonight I would like to discuss a proposal for North Penn School District's recess policies this year at sixth grade I mean this year as sixth graders we noticed a significant drop in our recess time I along with other sixth graders feel that 15 minutes just isn't enough time we see that we feel that right when we are starting to relax and enjoy ourselves it is time for us to go back inside in addition to extending sixth grade's recess I would like to discuss North Penn's Middle School's no recess situation since I will be transferring to middle school next year it has come a topic it has become a topic of discussion among myself and my friends we feel that there is no reason that they
016shouldn't have recess too High School is allowed to have outside time during their scheduled lunch time so that so it has come to my understanding that middle school is the only age group that doesn't get access to time outside studies done by the Center for Disease Control also referred to as CDC states that recess can increase a student's overall physical activity leading to a potential decrease in obesity increasing a student's physical activity with extended recess can have many other benefits including increased memory attention and concentrate and concentration for students including wait nevermind would you want to stay on task in class CDC also recommends more recess because it can reduce disruptive behavior in the classroom additional outside time allows for a clearer mind which facilitates more creativity recess is beneficial for students social and emotional
017development extended recess also allows teachers to have additional time to relax and it allows them to reset before the next class Studies have shown this allows teachers to be more patient with their students all of these benefits can improve a student or Teacher's Day bringing a better overall classroom environment for all in conclusion more recess has many proven benefits I would like to officially propose that sixth grade recess across the whole District move from 15 minutes to 25 minutes in addition middle schools should be considered for 15 to 20 minutes of recess or outside time if the weather allows I've gathered signatures from both students and staff members on my school in support of my proposal thank you for your time and consideration so Ryan I do have to tell you that of all the
018school board meetings to come to this is the one time that the director of elementary school has sat up on this board so Dr McKenna is actually sitting in this evening to kind of run the behind the scenes board docs and things for Mr scrapkey who is away this week so Dr McKenna was here to hear your speech and I promise you that within the next week he will come over to Inglewood sit down with you and some of your friends and talk about this okay you did a great job let's take a minute and congratulate you on that speech Ryan that was that was fabulous I think you know your audience right because we like data and you brought it you were very persuasive so uh good job as the guy that was very
019supportive of limiting homework I would say that I liked where your ideas going well done thank you bye hi my name is Juelz Santana and I am a sixth grade student at Inglewood Elementary and we have come here to discuss a few proposals about the North Penn School District's recess polities it has come to our attention due to discussions with other students at our school as well as students from other North Penn School district schools that students don't receive enough recess time as we think is enough we wouldn't just be doing this for us in our sixth grade class we're doing this for all of the schools throughout the school district that have been giving a small amount of recess for example on March 15 2023 our recess was shortened because of the weather which
020made a lot of students displeased we also as sixth graders ourselves think that 15 minutes doesn't feel that long when you're enjoying yourself and that's why other students have said in the past that it feels shorter than it actually is we would also like to talk about the North Penn Middle School's no recess situation because we feel as if there's no reason they should have recess they're they are kids and students just like us and it is unfair for them for us to get recess and for them to not get any some good reasons that recess should be intact is because they're Centers for Disease Control or the CDC states that recess is beneficial because it can increase a student's level of physical activity an extended amount of recess can also improve memory attention concentration
021and social and emotional development when children participate in unstructured play time they can burn off energy and pay attention more in class this helps improve grades and behavior and also allows children to learn great skills such as teamwork and Leadership thank you Joe I'm sure Mr Dr McKenna will be visiting with you as well right you say another fabulous job and hey how about Inglewood right it's a great products are coming out of our school exhibition well done games I just want to say that you two make a very persuasive argument and you are a dynamic team so thank you so much for working together on this you guys were fantastic and Mr McKenna if you need a board member's support when you go and conduct a focus group at Inglewood during Elementary I mean
022during recess let me know something tells me the vote will be unanimous wait when was that you said when was that that he came to you okay and he put a petition together position research speech okay thank you that is good thank you okay so I guess we will start then with the adults for the uh public comment and as I said before I believe Mrs Altieri was the first one to find out so she's been sitting my name is Denise altiri and I reside in Lansdale Pennsylvania this board of directors likely pleased that you know who my husband is but just as you are sadly mistaken about what your role should be to the North Penn School District Community you don't have any idea who my husband really is when my husband asked me
023for my input on whether he should run for school board or simply just focus our attention on pulling our child from North Penn School District I really didn't know how to answer after some thought I asked my husband why wouldn't you run I pointed out to him that I could already see how passionate he is about the concerns of many in this community for the record his concern is that the lack of transparency in the political agenda of the school board has led to the undeniable slide in North Penn School District's school rating my husband's answer to my question surprised me my husband told me that because the board of directors is so concerned with their own agenda that they would not shy away from attacking anyone that supported him on a personal level trust
024me my husband could care less if you attack him while no person is perfect your attacks on him will not deter him rather your attacks will only strengthen his conviction but what might of have deterred him is your attacks on the people that he loves those that aren't in position to defend themselves that is where my husband's heart really is defending those that aren't in a position to defend themselves my husband stands up to this board because he despises the lack of transparency my husband has zero agendas where political motivations when it comes to children and parenting this board of directors does and that concerns us greatly this is also exactly why this community needs my husband on the board of directors he will hold each of you accountable as it stands now this board
025of directors is like the secret police with an agenda of disrespecting and shutting down parents after three minutes on a personal note I want to address you Mrs Stoll not as an elementary school teacher for more than 25 years but as a parent and a mother my husband gave you ample opportunities to address a school nurse when she told my impressionable child that she should be vaccinated as the president of the North Penn School District and most importantly as a mother you ignored my husband until he was forced to call you out in public at that point you doubled down and condone this action just as you have no right to silence parents after three minutes provide your opinion on gun control or to support statements that virtual learning is effective and as an educator
026I know it's not just to name a few how dare you allow anyone to parent my child again as a mother and a parent your actions are unacceptable and I personally will never forget what you allowed as my husband often States what you allow you teach thank you Miss alquerry brought you Mrs bracio did you want to come good evening my name is Pauline brachio I live right here in Tomlinson Township and I'm really happy that you guys are here tonight because it was an easy drive for me um I didn't really have anything prepared and I'm glad that I didn't because it leaves me open to back up with Mrs Altieri said um I think the biggest issue that the school board has is that you are allowing teachers nurses and other staff members
027to talk to the children and the students behind parents backs you're not transparent at all we already know you have an agenda and it's a terrible agenda because it's really not your business what children want to do and want to be it's up to their parents not you you are really nobody to these children and um the fact that you have such a how can I say it liberal which is too Vega word but you have a specific agenda to actually indoctrinate these children to believing things that they would not ordinarily believe and also forcing them into situations that they don't need to be forced into I was very impressed with the North Penn High School students who came up here and spoke because it just showed you how just having a program that they
028can join and they can participate in they actually make friends with each other without having to be forced into CRT or Dei or SEL or any of those other ridiculous initial things they can actually become friends with each other on their own if you just give them the platform to do that or the program to do that the program being sports or arts and crafts or whatever other kind of imaginative imaginative thing they can do children students even teenagers will get along just fine if you leave them be just give them opportunities to be themselves you don't have to force things down their throat you don't have to talk behind their parents back you don't have to talk to them into being one gender or another or being gay or not whatever they are they
029are let them be who they are and as I said just give them the opportunities that apparently they can have here and they will get along just fine everything else is just your interference and you're wanting to control and handle everything it's really not your business the only business you actually have is giving these children an education that's it their lives outside of school is their business and their parents business their family's business so all I'm asking you to do is butt out thank you thank you for anyone else who would like to make public comment this evening Mrs Flannery all right so I'm Vicki Flannery I'm the chapter chair of Montgomery County moms for Liberty I'm also a North Wales resident over a year ago I came to you all with a discovery a
030parent made in their child's School here in this District Oak Park Elementary this book titled all boys aren't blue an extremely graphic tale of incest and rape between a boy and is much older relative who was read by me to you the board I had mentioned during my speech that this parent upon finding the book had immediately called the principal of the school and he had the book swiftly removed from shelves and action confirmed by at the time assistant superintendent Todd Bauer I appreciated this action and I still do recently I calculated and disgusting attack was launched upon my chapter by a member of this board Christian Fusco wrote an absolutely defamatory article in order to paint moms for Liberty in a bad light I'm not sure yet if it's for votes accolades virtue signaling
031or all of the above but what I do know Mr Fusco is that you are completely wrong moms for Liberty supports all students including lgbtq Plus in their right to a free and fair education we have no intent to quote disenfranchise any students what we do not support is the exploitation of students in any group for a political purpose like you have we do not support calls for violence by anyone in the community or outside of it like you suggested in your article we cannot and will not justify pornography being placed on shelves in school under any circumstances unlike you do in your article we do not support a call for the Banning of any books we would however like to see apology policy change that allows us the parents to see know and decide
032which books should be allowed within our children's schools and remove anything inappropriate as defined by Pennsylvania law we need to focus Less on hyper-sexualizing our students including the lgbtq Plus in schools and focus more on raising our test scores and school ranking which has been on a double-digit decline since the nine of you took office moms for Liberty wants to positively and respectfully engage with you the administration and all of the wonderful Educators within this district for the betterment of all of our students again we support all parents and their rights in ensuring that their child receives the best academic and least politically indoctrinated education thank you foreign ER Lansdale um I'm going to try to tie some of this together with the presentation you had at the work session talking about rankings and trying
033to re sort of reiterate what was said before um prior to you guys taking office we were ranked 11th in PA we're currently 47. 47. we've dropped that far um and the solution you guys come up with isn't to double down or try to help kids that need need additional help it is to introduce things like Dei and CRT or SEL or equity and inclusion and you go so far as to add this to the hiring process so instead of hiring people who are qualified you forget that and hire people who have and I quote the ability to support a culture of equity diversity and inclusion so less qualified more inclusion is that how we're to understand it and what have we had we have had dropping academic standards it shows in the in the
034in the uh the PSA or the the Pennsylvania's um I guess this Department of Education we're right we have a 58 58 uh percent compliance or proficient in math 58 percent in your solution isn't to double down on trying to keep kids better education it's to build a huge High School with the with the with the Ninth Grade Center um Ninth Grade Center might be needed and that certainly the the high school needs to be repaired but it's it was clear to me at that meeting that all of you have already decided that you want to build do the full renovation this the 400 million dollar renovation and do you know what that means for the taxpayer that that's a service a debt load service of eight hundred thousand dollars for the nine the The
035Ninth Grade Center and the high school renovation eight hundred thousand dollars sorry 800 Million numbers 800 million dollars and if you include all of the capital Improvement projects you have for the other schools the increases in salary that we're talking about in the same time period you're going to be well over a billion dollars in debt service for the taxpayer and we're to believe this is going to somehow better the education by building these huge Cathedrals for learning there are plenty of schools not far from here who don't have huge Swanky buildings that don't have lots of Open Spaces that don't need to go to newfangled ways of of introducing education when we introduce these newfangles we drop in in performance we look at other schools you look at schools uh LC or uh Christopher
036docs they don't have these sorts of things and they're they're doing much better than we are so I think this needs to be clear how much money that you guys want to spend for a reason that is not good for not necessarily good for the education of students thank you thank you is there anyone else that would like to make public comment this evening my name is Joyce Snyder I'm a citizen of towel medicine I wanted to take the time to thank each and every one of you for the incredibly large amounts of volunteer hours that you have spent in the last two years four years six years eight years ten years however long you've been volunteering being quite honestly I've lost track but I know that all of you have been working very hard
037for a very long time to create better education and I know that my four children one of whom graduated before you get any of you were ever elected two of them graduating before you were ever elected have all benefited from that and I just wanted to say thank you all for your time thank you thank you is there anyone else okay seeing none we'll move on then to the approval of the minute from February 16 2023. do I have a motion so moved second a couple of problems with the the current uh minutes one again there's no minutes showing the meeting that you guys had on March 2nd 2003. and I'm not even sure why it's not even being discussed but when you when you go when you look at what the definition of a
038meeting is according to the uh oor you guys had a meeting on March 2nd 2003. did you discuss this question is noted it was not a meeting it was a campaign event we are allowed to meet in public and you're allowed to discuss in a quorum you are not not a quorum to discuss school board business you have any other objections so do you have any other thing to object to do you have any other objections uh I have also an objection in the fact that the committee report for personnel is not included and therefore it cannot be voted on it was not included maybe it has been now but it wasn't included as of 24 hours ago your judgment email is so true it was not included you can there's there's a number of
039people up here who can Testify the fact that it was not on the uh there was no link to it there's no nothing I'm not saying anything about the other reports but the Personnel uh was not added so it should not be voted on the just to clarify the Personnel committee report that's correct there is no vote on that um and there's no personal meeting on our committee report there's no Personnel report sorry it was it was uh the Personnel contracts is that what it is um superintendents what's that one month well if you have no further advice it's not if it's not there you can't you can't vote on it it was there it was there not that I saw all right hold up hold on a second just give me a minute I
040think I know what you're speaking of Miss villanier um so there was a point the Doctor Kim can you forward me that document from board docs again I just can't find it right now so the um Personnel committee attachment was posted with the agenda yesterday um it was taken down for a brief period of time because there was a editorial change a a mistake on the agenda so perhaps that's what he's talking about but I have a log of what it was posted taken down and replaced um there were a few minutes when it was removed because something was wrong Mr Summit sure um okay and so the objection is with regard to that being posted last night in this morning and it was not there okay um and at this moment the agenda does
041include a Personnel uh report it is it is the contractual item that that okay so but 24 hours prior that that can't be it was just to be clear miscellaneous it was posted 24 hours well in advance there was a period of time where it was taken down because I believe a salary or a step or a year was wrong and it was fixed and reposted and and the Sunshine act does require that the the agenda include a list of all matters the the matter of personnel certainly was on the agenda that was posted thank you Mr Summers any further objections Mr linear your objection is noted he responded I no I would like to get on with our committee report I'd like to move on so we'd like to get on with our approval
042710 said that you guys get to make your own rules correct zero zero zero six you get to make your own rules get you don't follow your own rules which has to do with Robert's Rules of orders you you do not you do not uh uh take the objection to the entire board and ask whether or not they will accept or deny the the change to the agenda and or the policy yeah okay so you need you need to do that the process that as I understand it is our Council suggests whether or not any of these things require a vote and up to date you haven't come up with one yet so I'll defer to my counsel Mr Lanier can we please start this meeting sir we have actual community business there's no rest
043so do you have any further objection I understand your objection relative to asserting that there was a meeting that uh was not properly held and the response to that was that there was no meeting in accordance with the sunshine act I understand that's your objection then you indicated that there was not an attachment included to one of the agenda items do you have any further objections beyond that what is your other objection the other objection is that you actually have to you have to sustain whether or not that is a true talent and then that it that it will be uh adopted into the agenda items or it will not okay I understand you're you're concerned with the the pro the procedure for responding to objections do you have any further objections beyond that okay
044so that concludes your your objection so with regard to the objections that were raised um my recommendation is to proceed with the meeting I do not believe that any of the matters that were raised uh constitute legitimate Sunshine act violations thank you Mr Summers okay moving on so I have a motion so are you raising a sunshine objection okay that that doesn't constitute an objection under the sunshine act you're not asserting any particular section that's been violated okay Mrs Bradshaw after Summers already made his we have a motion on the floor we have a second there's no further comments or questions all in favor say aye aye any opposed motion carries moving on to the committee reports Personnel the Personnel Committee of the board met on March 7 2023 to discuss matters of personnel including

056March is a governor Shapiro's first budget proposal as addressed in the finance report include a host of supportive steps for Pennsylvania's K-12 schools including tax credits to teachers who become certified in Pennsylvania or move into Pennsylvania with certification this is an important part of the plan I read a decade ago Pennsylvania had certified 20 000 teachers last year it was just under six thousand there's also in the in the budget a 7.8 increase to basic and special education funding formulas to cover inflation costs 100 million dollars uh has also been added for mental health support grants and a 60 increase to Career and Technical education equipment grant funding our neighbors are encouraged to review the detailed analysis provided uh by our own Mr scrocki at our most recent finance committee meeting that's available online whether
057it's on YouTube or nptv YouTube or Facebook though we're still very early in the process the house and the Senate will hold separate Appropriations budget hearings it's a PA House and Senate with officials from the Pennsylvania Department of Education on March 27th and 29th respectively stay tuned as the process moves forward thank you Mr casa that concludes our committee reports so we will move on now to our solicitors report Mr Summers please thank you madam president I do not have any um specific report tonight however I would just add in terms of the objections that were raised earlier one of the specific objections relating to the Personnel item under 7 a the uh the attachment the district has acknowledged that the attachment itself was revised within the 24 24-hour period of tonight's meeting so to
058avoid any concerns being raised at all my suggestion is that is that we do have the board act to amend the agenda to specifically include the attachment as it currently exists on the agenda that is publicly uh posted at this time that would avoid any concerns about whether the the attachments as they um are currently on the The District's website whether those are are exactly what was added 24 posted 24 hours in advance my suggestion is that the board um simply move uh to amend the agenda to include under item 7A the attachment that is currently posted on the website um and vote on that item that will uh comply with even the process under the sunshine act for amending an agenda and avoid any issues at all given that it is Personnel items that
059we're talking about it's important I think that we avoid any any concerns being raised with the regard to that item okay so should we do that now I would suggest doing that now so um the the motion would be to amend the agenda to include the Personnel items as they are currently posted on board docs um under item 7A Personnel thank you is that a motion so move no second second and I would before taking a vote on that item Madam president make available public comment on this specific item only with regard to uh amending the agenda to include that attachment okay so we have a motion on this floor um this one you want to want to make public comment at this time I mean because it wasn't posted prior to me coming here
060so it was posted I mean you want to give sometimes allow people to read what what you posted so it was posted out last evening at five o'clock and it was it last evening at 11 o'clock it was not on the website I I don't know what to tell you Mr linear it was posted last night at five o'clock I will take it again this afternoon I will tell you that two times uh I've talked with Mr Rocky about this if it's not made visible so even though it's been posted if it's not made visible in board docs it's not available for anybody to see we had this issue with the minutes a number of times I I sent him a lot a list of 35 minutes that we're not able to see uh Dr
061McKenna please just start the timer um this is public comment so Mr Lanier's welcome to comment for three minutes I haven't been able to see the report so I have nothing to say on that can we table this motion till the end and let Mr Lanier go read it while we do the other committee business or I don't know so um the the motion that is is being made right now is just to add this to the agenda so it is not actually the vote on the item itself certainly um the the board could vote on that item last okay okay so Mr one year to go read it and we will go down with the rest of the voting on the other matters and we will come back to that if you need an
062iPad I have one that you can read along with I appreciate that well okay are there any other comments with regard to amending the agenda thank you so can we move on to the superintendent's report so Madam president there's been a motion a second an opportunity to comment um and my recommendation is to vote on amending the agenda to include under item 7A as an attachment the attachment that is currently posted on board docs as the Personnel agenda right so we have a motion on till the end now okay all right okay all right so motion on the floor all in favor say aye aye any opposed motion carries okay so now we will save the Personnel item in section seven for last Mr Mr Summers um Mr Lanier raised a similar objection the other
063night and it was about an attachment to an item and I believe your response was that it's the the agenda does not necessarily have to have the attachments in order to comply with Sunshine law requirements that's correct the the issue is that the the matter the sunshine act and this is a relatively recent um Amendment to the sunshine act says that the matter uh a matter before it is voted upon is required to be posted 24 hours in advance with regard to the other evening it was a board work session and there was no action being taken um with regard to in that case the presentation that was being shared with the board thank you for those who are paying attention I think [Music] okay so we'll move on to the superintendent fine Dr Bauer
064sure um so I recommend the items as included in the consent agenda which is adoption of policies repeal of policies adoption of policies for a first read contracts student travel approval to advertise for bids and request proposals approval to advertise for bids Workforce retention Grant 2.0 student agreements and alternative placements do I have a motion so moved do I have a second what is your objection you have an illegal uh statute that is well as much as Mr Bauer is a good guy he cannot be the 10th member of the school board okay you're the right to make an objection during a meeting is only objections under the sunshine act do you have a sunshine act objection okay please have a seat you've never you've not indicated any objection under the sunshine Act okay okay
065you are not alleging any violation at this moment of the sunshine Act and what is it that you made you're not you're violating your own policy 7 10 okay concern about following policy is not a sunshine act objection thank you Mr Summers you've had an opportunity to comment and your your objection has no validity just gave you his device you could look it up yourself and see what it says we have other business to address we have the community business to get to and you're using this obstruction you're using the substruct you're using this process in the law to obstruct the community's business and frankly I'm getting a little tired of it the fact that you don't understand certain things about this process is not a reason to slow down these meetings Mr Lanier have
066a seat there's no further comments all in favor say aye aye aye aye any opposed motion carries thank you okay the next item uh under the non-consent agenda uh skipping over item a is B I recommend the approval of deduct change order c28 to low bar Incorporated in the amount of two thousand one hundred ninety eight dollars and forty cents per reimbursement of mechanical and plumbing change orders I also recommend the approval of change order 29 to low bar Incorporated in the amount of 2727.61 for the change of expansion assemblies offset by allowance zero one B I recommend the approval of deduct change order 30 to low bar Incorporated in the amount of 239 544.43 for a reimbursement of unused allowances I recommend the approval of deduct change order 7 to micro medical it's a

068administration gets credit for seeing this project through and especially with his may change orders as we've had also commence our colleague uh chairpersonal facilities and operations committee Kathy Wesley for really working with the administration to understand every single one of these change orders and what they mean down to each penny and I we appreciate the negotiation with Mr Slaughter uh with our contractors to get the best return on investment for taxpayers so thank you for what this represents thank you Mr casa are there any other questions okay we have a motion on the floor so all in favor say aye aye aye any opposed motion carries I recommend the approval of change order C1 to SJ Thomas in the amount of 501.99 for providing a CB sanatory sanitary excuse me Saddle do you have a
069motion so move second motion by Mr Fusco and seconded by Mrs ramich any comments or questions seeing none all in favor say aye aye aye any opposed motion carries I recommend the approval of the community ed program fee schedules for our 2023 summer camps do you have a motion second motion by Mr Fusco and seconded by Mrs Bromwich any comments or questions being none all in favor say aye aye aye aye any opposed motion carries I recommend the approval of a contract with Johnson Controls in the amount of Thirteen thousand four hundred and sixty five dollars for the installation of the high school senior cafeteria rooftop HVAC unit so so much I have a second second Mrs ramage and seconded by Mr Casa any comments or questions all in favor say aye any opposed motion
070cards okay next I recommend rejection of the real estate tax bill printing services bid we saw that coming didn't we have a motion please so moved do I have a second second motion by Mr Fusco and seconded by Mr resch um if there's no are there any comments or questions all in favor say aye aye any opposed motion carries and lastly I recommend the approval of the transfers to the Capitol Reserve fund as per the attached resolution of note for the community Mr skraki gave a very detailed explanation of these transfers earlier this month you have a motion so moved second motion by Mr Fusco and seconded by Mr casa are there any comments or questions seeing none all in favor say aye aye aye any opposed motion carries okay next we will move on
071to the finance report and not that I can do this Justice and Mr scracky's absence um but I will say just in honor of him that he is very proud of the tax rebate program and the health care center so uh if I may I recommend the approval of the treasures report for the month of February 2023. you have a motion so move second motion by Mr fascal Ed by Mrs Ramen comments or questions all in favor say aye aye aye any opposed motion carries I recommend the ratification of disbursements for the month of February in the amount of 21 million 877 961.59 do you have a motion so moved you have a second second motion by Mr Fusco and seconded by Mr Casa any comments or questions all in favor say aye aye any
072opposed motion cards okay and lastly for uh action in the finance report I recommend the approval of the attached budget transfers for February 2023 in the amount of 209 142.71 cents do I have a motion please second motion by Mr Fusco and seconded by Mr Casa any comments or questions all in favor say aye aye any opposed motion carried and just for the benefit of the board and the community um there are Financial reports listed here in board docs we have the revenue report expenditure report and investment report that is all for me president Stoll thank you Dr Bauer very well done oh let Mr sprock know he's watching okay now we move on to other business um all right so um at the facilities and operations committee meeting Mr Schneider and Mr olinsky presented
073a bit about our act 39 LED in drinking water testing protocol and Ms Wesley asked that uh either Mr Linsky or Mr Schneider just give a full report out to the board this will be brief just a couple minutes just kind of letting everyone know which access points we are testing and why so Mr Schneider good evening foreign [Music] um foreign systems in 1996 the um Safe Drinking Water Act was again amended to limit the amount of lead in brass and bronze fixtures at the end result and then in 2011 there was another act that was passed for the reduction of lead and Drinking Water Act that defined what lead free was and made the limitations stricter so our history of testing for lead in 2018-19 North Penn School District tested 548 locations which included
074all water fountains in the district it included all kitchens all break rooms um it included the kitchen food prep areas and out of that 548 10 locations exceeded the 15 ports per billion limit and each one of those was subsequently remediated in the period of 2019 to 2021 we had public meetings and we did not test for lead as a result of the coveted closures in 2021-22 536 locations were tested and again 10 locations were found to exceed the 15 parts per billion uh limit and they were subsequently remediated our recommendation for this year's testing would be to test all of the buildings that have not been recently renovated and the reason for that is all of the renovated buildings of recent that had full Renovations all came back in the last two cycles with
075zero hits for lead in the drinking water because in the full Renovations all the piping system the domestic Water Systems have been replaced including all fixtures all piping and all lead-free solder um these buildings that were recently renovated include Hatfield Inglewood hope Montgomery General Nash North Wales Northbridge and the SSC and that was completely renovated this year also we tested that in the last cycle and the only hit um for a high level of lead above 15 parts per billion was in a existing fixture that was installed in the 1950s next slide please this is a just an example of all the test results in the buildings that had some of the high hits next slide please our recommendation would be to test the water in the buildings that have not received the renovations including
076Bridal pass one or gwennett Square Oak Park Walton Farm York Pembroke Penfield Penndale the high school the ESC and the transportation building along with that we would recommend testing three of the newly renovated buildings Northbridge Culp and North Wales because they were renovated the longest period of time ago and then each subsequent year we would recommend testing all the buildings that have not been renovated and then cycled the newly renovated buildings um every other year so in a three-year cycle we would get all the renovated buildings tested so this was this is our recommendation for this year and we would get this completed prior to June and we would report out probably in the May facilities and operations meeting of the test results thank you Mr Schneider thank you any questions thank you I I
077would just like to comment thank you Mr Schneider your team Mr Linsky in particular uh over the years we've been educated about this process and very happy with the way that North Penn has relentlessly pursued uh finding any light and making those remediation so thank you appreciate your team's efforts to remediate the situation so thank you next up um under other business is the MCI board representative so we are going to recommend the nomination for Julian ramage to serve as North Penn School District representative for the Montgomery County Intermediate Union board of directors question for the term of July 1st 2023 to June 30th 2026. do I have the motion so move second version by Mr Fusco and seconded by Mr Casa any comments or questions has done a fantastic job representing North and on
078that board and since as their president at this time and I'm probably motion to have her continue to do so in that capacity so all in favor say aye aye aye any opposed motion carries thank you very much for continuing with that position thank you and objection the sunshine actual protection Mrs brachio Senate Bill 554 which amended the sunshine act does state that a physical copy of whatever is on the website should be present at the meeting site and you don't have that and you've never had that as far as I know so you are in violation of the sunshine Act and by the way the board yourselves should start learning about the Constitution and the Sunshine act because when you are sued as Pennsbury School District in Bucks County was your solicitor is going
079to come out with more money and nothing's going to happen to him because you're not a member of the board I suggested the board members themselves learn what you have to learn for yourself okay thank you so much Mr Summers do we have any sure just um the objection was relative to copies of the agenda and there are copies of the agenda available physical copies of the agenda available here at the meeting okay I understand the objection is is that not every attachment that is posted to the agenda is available in physical copy and there is no indication under the sunshine act that every attachment to an agenda item needs to be available in physical form again I understand the objection and my recommendation to the board is to proceed um as having satisfied that
080requirement thank you Mr summer Mrs bracio thank you very much thank you Mrs broccio and miss you are not a uh ma'am would appreciate some decorum and that is not if you should know the school board policy you're not to make statements about that about those who are here at the board so please have some civility thank you moving on to the next Mrs broccio Mrs brazio please don't be disruptive Mrs Mrs Bradshaw please stop yelling out from the audience thank you Mrs brachia no I would like you to be quiet please we're going on to the next thing we're coming out well I'm I have the gavel I have the battle so moving on to the rise act resolution Mrs brachio please stop okay and next the Third Mrs broccio please I know the
081next piece of business under other business is the rise act resolution Mr fresco thank you please take this thank you as you may or may not know the iconic civil rights Warrior Judy Hyman died earlier this month she was a Trailblazer in the fight for equal access for people with disabilities in all facets of their lives as assistant secretary for the office of special education and rehabilitative services under President Clinton she was deeply invested in making sure that students with disabilities have an equal shot at becoming successful financially independent and whole adults is Judy Hyman who said quote disability only becomes a tragedy when Society fails to provide the things we need to lead our lives job opportunities or barrier-free buildings for example it is not a tragedy to me that I'm living in a
082wheelchair Duty was stricken with polio at the age of 18. inspired by Judy Hyman's Legacy the board tonight chooses not only to speak but to act by raising awareness about important legislation uh that we the North Penn School Board of Directors as Community Representatives support that legislation is known as um The Rise Act resolution and support of the federal I'm sorry respond innovate succeed and Empower rise act it ensures that the rights of everyone um going to college have the same opportunity to succeed so the rise act aims to simplify the process for students looking to secure needed accommodation in college settings the same accommodations that you use to navigate their way through High School under the rise act colleges would be required to accept a wide variety a wider variety for that matter of
083forms of documentation such as an IEP 504 plan I noticed from a doctor or an evaluation by a psychologist as evidence of the need for these types of services on a personal note I work with students with disabilities it's been well noted many in high school and I have had discussions with them about this process of working with an office of accessibility on a campus on a college campus what documentation they need to have like audiograms or other documentation there are other students those that have dyslexia or ADHD the types of disabilities that seem to be invisible to people who are unaware of individuals conditions but but these types of situations impact Student Success in a dramatic way your responsibility to relieve these young people of this burden and make the process of securing these
084necessary accommodations easier on them and on their families tonight I and my fellow board directors Jonathan Casa and Julian Julian ramage read the language from the resolution and then Mrs stole will ask for a motion to pass it and send a message to Congress to get this passed I'll begin whereas U.S senator Bob Casey the support of bipartisan members of Congress has introduced the respond innovate succeed and Empower or rise act each Congress since 2016 and whereas the rise act will help to ease the transition from high school to college for students with disabilities the legislation would amend the Higher Education Act and clarify that students with previous documentation of a disability would be able to continue using that documentation as proof when they are transitioning the high higher education and whereas the rise act
085would help to ensure that students receive special education or accommodations because of a disability do not need to allocate time and money to go through unnecessary testing for an already diagnosed disability and whereas the rise act would also streamline processes and increase transparency to allow students and families to make informed decisions on the institution of higher education iag that best fits their need and whereas the rise act would provide support for technical assistance for ihes to better serve students with disabilities in the enrollment process and whereas the board represents School community that educates more than 2 000 students with disabilities annually many of whom who seek out opportunities for additional learning after their graduation from high school and whereas the board deems it unfair and unacceptable for families and their students with disabilities to have
086bureaucratic and financial burdens placed by colleges and universities thus the board advocates for the removal of these obstacles to accommodations for lifelong conditions already established during students with disabilities K-12 educational experience and whereas the board implores our representatives in Congress to work with urgency unity and common sense to address this critical civil rights issue so that all North Penn School District students receive the same uninhindered opportunity unhindered opportunity to reach their full potential and now therefore be it resolved that this the board of school directors of the North Penn School District supports the reintroduction and passage of the legislation set forth in the rise act to ensure that students with disabilities can more effectively navigate the transition from high school to higher education opportunities thank you do I have a motion please so moved you
087have a second second motion by Mr Casa and seconded by Mr Fusco are there any comments or questions seeing none all in favor say aye aye any opposed motion carries thank you you still have item Dad yep oh yeah we have to type the Personnel report okay Mrs Stoll and prior to my uh recommendation I would like to see if there's any public comment on the Personnel agenda item um Dr Bauer before we move to that I just wanted to make one um quick note that um before we get too far into the weeds of personnel that um this month is developmental disabilities awareness month I don't know if we mentioned that at the beginning of the meeting or not so it's a good time for us to just stop and um recognize and honor
088all of the teachers families and partners in our community who support any of our children with developmental disabilities having been this my 25th year in education and I also have the privilege to be able to work with lots of families um and partner with them and we're just very appreciative of all of our teachers and everyone who um devote their lives and just supporting all of our students with disabilities so this is a good time this month to raise awareness about that within our community thank you the Sony yeah thanks uh thanks for reviewing that and giving me an opportunity to comment I Mr uh Rush was kind enough to let me read his version or read it on his idevice I'm not sure what what that was um in any event read through that
089didn't have a lot of questions about that didn't want to also go back to the policy 011 um not to me it seems like if you were going to pass a policy which you guys did you should follow your policy your policy 011 says uh collaborate with the superintendent acknowledging their role as the 10th member of the school board commission officer Inc of the Commonwealth Dr Brown is a nice guy I don't have a problem with Dr well unnecessarily Dr power cannot be a member of the school board it says it specifically I'm just going to say that that is like common language that's used throughout all School boards he's a non-voting members what he's considered it can't remember and he's not superintendent he's better than non-voting 10th member of a school board Mr that's
090the case in every school district you can't say non-voting number see and and that's that's understood not allowed to be a school board member he's not he's not well you you wrote up actually because he's saying he was so uh that aside um this opportunity is just a common operation actually you cannot hem in language when there's public comment yeah absolutely this public common opportunity is solely on the added item the Personnel report that was added to this agenda there's already been an opportunity for public comment on other items that are before the Border may come before the board this opportunity is solely to comment if there are any comments that anyone has on the Personnel agenda as it's been amended and added to the agenda so you are not permitted to pen in language
091based upon your you you can't you can't conspire my language you can't contribute board provided an opportunity for public comment right there was an amendment of the agenda to add the Personnel item so there's an additional comment period being afforded to anyone who has specific comments on that item that was added that's your opportunity now do you have any further comments on the personal report but you're not allowed to do that you absolutely are and if you're free to disagree with that but that's can you connect the the where you're allowed to do that the the board has fully complied with the sunshine act by affording you an opportunity to comment um and you've had that opportunity my recommendation to the board is that the board has met uh this requirement is there another individual
092who wishes to comment on the Personnel report they'll take a vote let's just vote on it I believe there's another comment all right 20 seconds and we're voting on it your comments are supposed to be on the Personnel item not on the policy what I'm allowed to speak about actually in this case I can't because it's a public comment is typically designed to address which is not on the agenda is for this is also in policy I'm getting into it let's vote have a seat please there's another another public comment there's another public comment I'd like to hear we also like my public voice I missed public comment but um I guess this is Personnel um everything um included um funny how you speak of the rise act I'm currently in the process of making
093the painstaking decision to play this opportunity I understand that but I'm this is but Personnel I'm speaking about the Personnel that has failed my child am I not allowed to speak about that yeah maybe before am I not allowed to speak about that go ahead all right thank you um pain staking decision to pull my non-verbal son from North Penn we have a school that offers anything you could imagine why can't we meet his needs and others like him I have put him on a bus 45 minutes I would put him on the bus 45 minutes away to get his needs met that is not excellent I know you're all tired of hearing about these issues the failures and and the painstaking decisions we have to make for our children every day just think how
094it feels for us parents who have to live it every day worrying about their child's outcome how about we take a detour on the 21st century bus to the Future to find what alternate placements are doing and implement it here our high out of District placement spending Millions is a key indicator that our schools are not meeting the needs of our whole Community we are now in a healthcare business why when will we be in the business for all children where are their allies okay now I will recommend the approval of the Personnel agenda as per the attachment the emotion still move do I have a second second motion by Mrs ramage seconded by Mr Fusco are there any comments or questions all in favor say aye aye aye aye any opposed motion carries thank
095you all right does anyone else have any other business this evening seeing none do I have a motion to a term so moved thank you very much this meeting is adjourned thank you foreign
