004new school facilities for the Department the legislature created School impact fees in 2007 with amendments in 2010 and 2016. section 302a-1603 HRS provide specifies that anyone Who develops new residences in school impact fee districts must pay impact fees including all governmental housing projects including our governmental housing projects until June 30th 2024 section 3028-1603 HRS exempts any form of Housing Development developed by dhhl for the for use by beneficiaries of the Hawaiian homes commission Act of 1920. although the department recognizes the importance and need for affordable housing adding additional exemptions with limit funding resources and therefore address the impacts on school facilities generated by these new developments thank you very much So Randy I guess what we're saying here is uh the impact fees wouldn't be built on any lands that the adhl Builds on housing
005projects until 2024. that is my understanding it exempts them till 2024. Okay so even if they have it planned it has to be built and what is what is the amount it varies from from location um I've seen the average at about four to five thousand per per house love per unit but for dhhl men's is it the same amount or is there a difference my understanding is the same thank you thank you [Music] okay Senate Bill 1596 relating to school campuses establishes and appropriate money for Maui campus housing pilot program to be administered I'm sorry to be administered by the school facilities Authority which shall make on campus how they're available to employees at Lahaina Luna and Fulani hakoi high schools on the island of Maui requires school facilities Authority and Department of Education
006to submit joint reports to the legislature um to testify through consumers agency Mr Scott Fuji presenting wheelchairs Vice chairs uh Scott Fuji military services officer on behalf of our executive director chances um we're offering uh testimony in support and I just wanted to note in addition to our written uh testimony that in the house companion um there is consideration in their committee report for a 200 000 200 000 plan design funding the blank Appropriations fund so I just want to provide that for the Committees and our bill does not uh the bill currently has a blank appropriation so just knowing the committee report on the outside so asking us to match it uh we would appreciate the amazing consideration for uh appropriation to take care of those Planet Zike costs we do not currently have
007fun we will consider it thank you we appreciate that thank you very much he's my former staff members questions thank you next to testify hsta Aloha chairs members of the committee Laverne Moore speaking on behalf of philosotory Junior president of the Hawaii state Teachers Association we support this bill and we stand on a written testimony and I want to mention that teachers need it badly on Maui there isn't housing for teachers and we have teachers living in tents in cars and it is drastic and important that we build it you build it they will come thank you hmm okay is mixi also testified oh okay foreign [Music] testifying for Department of Attorney General good afternoon chairs Vice chairs Deputy Attorney General Andrew Chi um a set course in our testimony uh what we noted is
008that the bill would have the pilot program be administered by the school facilities Authority but under statute the SFA doesn't have authority to administer a project so after they're done with the Planning Development and Construction the administration of the pilot program should really be handled by a different entity so in our testimony we have provided some suggested revisions that we think would address that Twitter members questions thank you um on Zoom we have Alice Lee present chair will be no no chair Nanny Medeiros not present chair Gerard Silva present chair thank you I guess is there anyone else here it's not we will deferred decision making materials um yes so we will do for decision making on this bill to Monday February 13 2023 at three o'clock P.M um in room two tonight that's great
009oh I'm sorry I didn't realize he was here members [Laughter] yes okay so we'll take a vote on this um I did not realize it was here of course of course she has to leave yeah I'll lose okay uh yeah all right so we're gonna go straight to decision making numbers and so for the committee on housing the recommendation for Senate Bill 874 relating to school impact fees is to um pass this measure element any discussion or questions if not um housing on SB 874 chairs recommendations or eyes share recommendations about them thank you and for the committee on education same recommendation delicious [Music] thank you okay so on the next time the gender Senate Bill 1596 related to school campuses it's establishes and appropriate 20 for a Maui campus housing private project to be
010administered by the school facilities authorities which show make on campus highly available to employers okay and we already took testimony so the recommendation of the chair is yes the recommendation of the chairs to pass out Senate Bill 1596 tea okay that's where the committee on housing Senate Bill 1596 same recommendation to pass on Amendment so I remember as president is there any reservations any nose five hours to your recommendations about it thank you okay um foreign and welcome to the 115 Meeting of the Committees on housing and on water and land um here with kindergarten housing it's myself Vice chair Senator kanupa and members Senators Aquino Rhodes there's also join early in offset and we're joined by and again water and land yes thank you to see you on housing perfect with Waterland my vice
011chair s live Vice chair Senator Senator elefanti and yourself Mr chair on the membership of the Waterland committee thank you very much so our first measure today is Senate Bill 136 relating to procurement requires an evaluating and determinating the determining the award for redevelopment of state and County Labs through competitive seal City or competitive sales proposals the number of housing units propose from constitute 40 of the evaluation score our first testifier is um Chief housing officer Office of the governor state of Hawaii with comments and standing on our testimony next we have um State procurement office with comments or is it true followed by Department of accounting and general services with comments understanding with comments and then office of planning and sustainable development with products thank you standing with comments is there anyone else wishing
012to testify on Senate bill 136. it's not members any questions for the new testifiers no okay we can move right along then our next measure is Senate Bill 139 relating to important housing lands which establishes that all state of lands located within a mile of any rail mass transit station excluding lands under dhhl shall be designated as important housing lands for specifier is dlnr in opposition good afternoon chairs uh Ian Harold Collin with blnr uh we'll stand on our testimony in a respectful opposition of this major and be available for any questions thank you thank you next we have dhhl with comments thanks standing on their comments next Department of budget and finance with comments Department of Permitting planning and permitting at the City and County of Honolulu and opposition and office of planning and
013sustainable development with conference anyone else who wants to testify on Senate Bill 139 if not members any questions well I'm not sure if it it's for those that testified but share with the um regarding the first measure which is 136 we're looking at developments on I think close to the real line at I think the recommendation was to was it half acre or there's some conflicts with with the um DOD uh in the two bills okay so the first measure calls for development within one half mile radius of the transit stocks and then as we see 139 that we're on is one mile so which is similarly I think with regards to the zoning part so what's your recommendation we go half a mile or we go one mile if if you're passing this with
014whatever measure so the first three bills on paper generation uh similar similar yeah so my information would be to move one of them oh okay um maybe convert one of the others into a study so okay we can discuss that sure just to recognize that there's differences of the locations great okay any other discussion or questions on SB 139 if not we'll move to our next measure Senate Bill 330 relating to hhftc which authorizes hhftc to ramp first refusal for the development of property for all development Upstate lands excluding hpha and dhhl that are within a half mile of a real transfer station a first testifier is dlnr electronics good afternoon chairs Ian here we'll call with dlnr I will stand on our written comments and be available for questions thank you our next testifier
015is hpha in support Master standing on their support department of the Attorney General with comments good afternoon Cherry noise members of committee we provided reaching comments to clarify the trigger dates as well as notice on date as well as exercise dates we stand on our comments and are available for questions thank you very much and then finally we have Department of Hawaiian Homeland Wisconsin foreign Bill 1286 relating to hcda which increases options to build affordable housing in Hawaii Community Development Authority districts by increasing the permissible lease term to 99 years our first testifier is hcba and support as a chair I think they're here good afternoon chairs and members of the Committees thanks very much for hearing this bill this is part of the administrative package and it is a bill that we put forward
016it's an idea that came up during last session But ultimately didn't make it out of session this would be we look at this as a proactive way to encourage the production of more affordable housing in our districts um a 99-year uh lease option or ability to do a 99-year lease on non-seated lens would give us a proactive tool to find developers who might be willing to develop a for sale lease sold affordable product is it the solution for all of the housing needs no but I think it's another tool that is not available to us that that we could use in a very proactive way and it would be a ground lease like we did with the hona holiday or Arts baseball so we thank you thank you a lot of time okay thank you
017okay and then finally we have the office I'm sorry the next we have d-bed with support okay and then finally we have office of Hawaiian affairs with comments okay anyone else wishing to testify on Senate Bill 1286 any questions or comments numbers uh HCBS I would assume and hopefully gather that um this would be used for all imits where whenever you have developments to occur yeah yeah it's gonna it could be used for everywhere where we have a Community Development District okay all right I just wanted to be clear because you mentioned a couple of names that were oaf so yeah just want to make sure that this is available for developments on all items so this the statute the changes put it in our general uh statutory framework so it could be used in
018other areas where we have a Community Development District okay thank you Senator all right now what happens if you have actually you know you're not at the other Islands right you only have coverages Land Development under your regime on Oahu uh we have kakako Kawai law and then we have a new Community Development District on the island of Maui okay we don't own land there but we do have a district there so it's a probably the county and an arrangement with the state then for you to take over some because we got a lot of State lands yeah Big Island yeah yeah okay we'll probably have more work for you in the future I think there's a lot of them there's a lot of details to be worked out sure but sure yeah sure thank
019you okay all right thank you thank you thank you director Nakamoto what about in the Aloha Stadium area just also include that uh I suppose it could um the actually the yellow Stadium area is actually one of our districts uh it has never had um a board constituted for it I suppose it it could be used but I also think that for that District um there's already that particular District I think there's a 99-year this that's what it has here the measure I was just curious yeah yeah I think yeah I think that District rules or statutes section already have has a 99 near me right there tonight yeah thank you for that and then one more follow-up is in kalai law how many acres does HDA have jurisdiction over it's about um 600 acres
020or so okay yeah thank you thank you Mr chair thank you thank you I'm actually one more question director sorry and I don't know if you saw oha's testimony on this metric I did okay so um we included the term you know non you know seated land um I I'm willing to accept that suggestion to add government lens to modify that um I I I would need to make sure that that's sort of the same thing um but I'm willing to accept that that um that suggestion by all can you do you know what the difference is between well that's why I'm gonna I think I'm gonna just to move this bill along um I'm gonna you know say okay and then maybe at the next round of hearings I'll research it and then I'll
021I provide comment area yeah I think that discussion should be held as well with attorney general because I think there are other instances and other bills uh that we use the non-seated lands okay because State lands can be all of the above so I don't know it would be good to have clarification yeah well I can I can I can I can discuss this with our Deputy attorney general uh if you prefer we can leave the bill as is and then address it in the next committee yeah and once and for all because they are like housing and in our committee in Waterland you know we do have bills yeah and we should be consistent yeah yeah thank you okay thank you thank you thank you members uh if not thank you very much um
022we'll move on to the next bill which is Senate Bill 1352 relating to housing establishes the rental deposit loan program and incentives to support the development of affordable housing local renters third-party reviewers and address government processes to lower housing costs our first testifiers Chief housing officer officer of the governor support stands in our testimony um hhftc with comments stand on their comments Department of Taxation with comments good afternoon chairs and vice chairs and committee members I am Gary Steven I'm a director of Taxation our comments are limited to section three of the bill regarding the g-e-t exemption and our suggestion to add a certification requirement um it could take the credit and I'm here to ask you the questions next we have Nayak Hawaii and support um written testimony text Foundation of Hawaii with comments
023uh chair Vice chair members of the Committees Tom yamachika from tax Foundation of Hawaii our comments are also limited to the get section and the the section as we read it uh seems to be very vague and we understand that there are efforts under a way to clean it up so uh if you had happy to answer any questions thank you um Hawaii Realtors and support [Music] um Pacific resource partnership support well I chairs Vice chairs and committee members Chris Delaney with Pacific resource partnership we're in strong support of the bill with amendments um our amendments are intended to incentivize developers to build more affordable housing and ensure that workers building those homes are paid a living wage there are a lot of proposed amendments that we offer but we have some priorities on page
024one of the summary section three is a priority of ours on page two section 10 is a priority of ours on page three section 14 and 15 are priorities section three is basically improving on existing law 21 h36a5 and it's just removing the 30 million g-e-t exemption cap and adding language that would uh or a removing language that would prevent developers from utilizing County waivers and exemptions so this will allow them to stack um Honolulu County currently has ordinance 18-1 that's in alignment with 218 3685 so we should use a Sizzle hanging fruit um section 10 authorizes that counties to incorporate labor standards into their zoning codes as a condition for obtaining benefits related to the flexibility and zoning section 14 and 15 um they go together and these are amendments clarifying that the payment
025of prevailing wages are required when using government resources to build a project such as government funds and lands unfortunately we're out of time I'm sorry okay great thank you great uh thank you again next we have um council member from County of Kauai support followed by council member Addison Wilson from Kauai County Council and support is there anyone else wishing to testify and Senate Bill 1352 Senators Nathaniel Kinney Hawaii Regional Council of Carpenters just wanted to stand and support and again we had worked on some of the Amendments with the Pacific resource partnership really those are to allow the stacking of County and state incentives and then also to make sure that there's some labor language to make sure that the people that are building this affordable housing earn a living wage thank you thank
026you anyone else wishing to testify on SB 1352 any questions or discussion nope okay uh we'll move on then to Senate Bill 1573 relating to affordable housing establish the working group within dlnr for administrative purposes to ascertain the state's available Water Resources pertaining to affordable housing first testifier is Neha in support Aloha I'm Greg Barber from Natural Energy lab in Kona we stand on our comments and support the Happy Day answering any questions thank you thank you very much then hhftc and support stand on their support dlnr with comments doing our standoffs comments Honolulu Board of Water Supply and support good afternoon members of the committee my name is Kathy Mitchell of the Board of Water Supply and the Board of Water Supply supports Senate bill 1573 but we recommend that the managers language in
027the purpose section of this act is amended the purpose to establish a working group that would ascertain available water resources and water system Source capacity and streamline will permit approval processes to ensure the availability of water supply it um if the working group doesn't have doesn't have that discussion not just about the available water sources but of the capacity of the board's water supply and on the streamlining of the the permits that could delay the affordable housing the government thank you Hawaii County Department of Water Supply and support Hawaii Realtors and support councilman Kauai County council member Keith and support Kauai County council member Addison Boulevard and support Cheryl B with conscience is there anyone else wishing to testify on Senate bill . thanks uh thank you and the next bill is uh can wait
028can you make some comments oh yeah sorry um it's interesting that um uh a Water Commission the state side recommends that this working group be housed in the governor's office um I'm just wondering why yeah so thanks for the question chair um because of the title of the bill really affordable housing and with our house chief housing officer we're coordinating Our Testimony with them while a lot of the focus is on water um and an analysis of water we wanted to make sure that we're coordinating closely with the affordable housing initiatives of the governor's office and that may be a better way to you know leverage all of that momentum trade it around affordable housing so it was just a friendly comment and potential recommendation as an alternative okay the question is regarding I guess
029you talk about is this measure always has a reference of third party I don't think so chair oh that's the priority we're at 1573 yeah okay I'm just kind of wondering because between um the Water Commission uh I'm sorry and her name was represented water supply can you come up as well let's let's talk about this um I I'm just kind of concerned that uh water is so important as well even though we're talking about housing and I think when you look at um the availability of uh water as well which is important and the mission is that um I I think I would like to have someone with unless you got their you're considering Contracting the workout and we don't know that right until such time that um this discussion will be made sure
030I I'm the way that I read the bill and the intention of it was to have this working group organized to have the first conversation about it so I don't think we've contract that out that would probably be done with the body as prescribed in the bill okay as identified okay because you know when we start and organize a working group um you know there is a mission uh and you know unless there's clear Direction um do we have a recording date here on this June oh okay so I guess there's the other reporting dated 20 days prior right to report back and that this is not dissolving on June 30th 2024. okay um perhaps um chair uh Senator Chang then maybe in the committee report we can say as they organize um this measure
031that uh at least some reporting to the committee or to the legislature as how you will proceed I think that's fair right because we're not saying you need to to create rules then if you need to create rules then you know it's a public then there's transparency and and you have to um do a reporting as well as taking it out to the public so either you can do that I don't know and maybe if Senator Rhodes can assist I'm not sure if any working group that was directed to the governor's office that we could tell that group that you must create rules you know we do it when we organize um working groups and and it usually is very specific in in the measure so a better off I don't remember never coming up
032before yeah yeah well sometimes I think out of the box and I think maybe my questions are I'm just curious because we are directing those stand the working group not specifically to the issue so you know water and land if there's or we're talking about um marine life and young brothers and mats and you know it's an organized group uh and okay so maybe we can reference um some reporting prior when you all organize then report to the legislature we may not be in session but that would be good for us to have a report and see how you're managing or how will this group be managed that's just some comments I'd like to offer I have no problem if you can take over because then he can use his own funding uh he's putting
033money in business he's paying for it yeah yeah there's no appropriation that I see in the thought that it so we would have to find ways to uh bring the group together exactly um because you know in your working group uh you're gonna have you're going to have County's representation yeah and different divisions within a county okay just some things to um for you folks to work on so perhaps in the committee report or maybe even in the bill that it says that reporting prior to implementation and completion of the organization that that they report back to the legislature that's fair yeah all right thank you thank you thanks so much for being here as well appreciate it further questions okay sb140 and this is um as we continue the committee on water and land
034and housing uh and 140 uh requires the office of planning and sustainable development to identify and analyze existing and protected housing needs and identify adequate sites for housing sufficient to meet housing demands for all income levels each year officer planning okay uh Realtors sense communication and support they were going to be here in person we do have three support um tested testimonies from Maui Chamber of Commerce will come around and keep [Music] in Support Office of planning can you come and share with us your comments please hello chair Scott Glenn director office of planning and sustainable development I have with me Katya balaciano the land use division administrator for the office okay say we'd like to know um you know your the comments that you have before us sure um so we we submitted testimony
035noting that we believe a lot of data already exists that can help with answering the the work that's being requested in this bill and also that there are other agencies with access to data and help generate data and that also in the past when op has done this kind of work it has been resourced specifically to do the work and that happened before Katie and I joined the office but okay so we're already doing the work it seems like in many ways yes this is your bill yeah okay all right okay um where are we with doing the work uh maybe I could defer to Katya sure uh we partner regularly with hhfdc they have contracts with SMS for example to regularly analyze the housing needs and they are primarily the source of that information
036in regards to the review of a quantity of state land opsd has identified the vacant Parcels the developed parcels and has maps and data in regards to the vacant lands that are available for housing and other Economic Development needs and we regularly update them work with the Tod Council reason I ask these questions and cheer as well um because for our recommendation hadn't I know that they've already have been doing the work I was going to add an appropriation for a position to assist you as well but you're all already doing it so just for our information I don't know that you have a list of say the 10 best sites that would accommodate say you know 65 000 units a thousand period not that I'm aware of in that in that particularity yeah no
037um not the 10 best sites right so I don't know that the level of specificity exists yes okay so but if we're talking about only one portion of site selections housing sites throughout and we already have the opsd already doing similarly work with what we're identifying in this measure then perhaps you can offer and we can ask them then to add that criteria what's in it you know to um to what they're already doing but that's just my opinion because it seems like it's a redundancy they're doing the work and they don't need a position [Music] yeah we could use a position okay okay in fact the governor's budget did include a position for uh for the work that you're doing for Transit oriented development to find the data that we have and continue the
038work that we're doing the Partnerships so that would be very useful thank you okay so if we pass this measure then a big and this is upon you um how would you look at this measure I'm sure we could we could go back and look at this in terms of what it would take to update to the level specific specificity that chair Chang has mentioned in the level of effort attached to that and report back to you because the idea and the measure is is a good one but you know and that's why I asked you um as well you know are you already doing the work and seems like you have been uh and it's on your table because you're responsible for Tod developments okay yes and and if I can just add we
039are working and as Katya mentioned in collaboration with hhftc and other housing agencies too just more of a comment please please don't forget mayor right Holmes it's a huge spot with buildings that aren't worth saving and it's going to be close to rail and it's just outside the flood inundation area so um I I I've been baffled for years is why we're not taking better advantage of that site that we own and um it's already affordable housing so there's not really any issue so just don't forget about it thank you thank you in more of a kind of a comment I guess as well dovetailing off my colleagues one you know I hope when you look at these things if you're creating these specific lists and this is kind of share this with my counterpart
040chair of Finance on the house side is a lot of time developers will pick places for projects and they'll build them and there's no supporting infrastructure and it comes upon the county and the state to come in and build new schools to build New Roads to build new water to run water out sewage sewage treatment plants which of course is puts a huge burden on the state and the county to now provide infrastructure in areas where there is none and per his point if you look at these lists if there's a way to identify supporting existing infrastructure that if the housing was built could then readily be able to provide the services needed accounting state level so that we don't have to come in later on and spend millions of hundreds of dollars in CIP
041for the think very things I talked about so thank you chairs I appreciate it thank you thank you any further questions to PSD thank you so much thank you thank you chair all right anyone else wishes to speak to sv140 okay hearing none let me say aloha to that then Mr chair we're back on our agenda okay so we take a recession okay there well I'm ready so are you ready [Music] all right well no recess then we'll just go straight into positioning um okay so um we'll start at the beginning um and as as we discussed briefly a little bit earlier I did the first three bills on this agenda kind of have a similar purpose and so um in the opinion of the housing chair um I think we can focus our attention
042on um third of these measures and convert the second into a study and that's for the first you know there really wasn't a lot of positive testimony for it and it seems like there are a lot of Kinks to be working out worked out on it so um terrorist inclination is to defer sv-136 [Music] um okay so for example 136 we'll be deferring that one we'll move on to Senate bill um 139 relating to important housing labs again it seems like there were some unanswered questions raised by a number of the agencies that testified and um I think one way to address some of these unanswered questions would be to convert this bill into a study to identify sites for 100 000 units of housing provide a budget of five hundred thousand dollars that have
043hpha conduct that study or contract for that study um and maybe we can get some more concrete tangible answers so um well just going back to the question I raised earlier about some conflicting um I guess language and you talked about the first three measures you're deferring the first one so 139 and 130 are we talking about um yeah you know the question I raised what are we looking at one mile or half a mile so I think um but now you're gonna are you what are you gonna do with 3 30. 3 30 amendments okay can we use um well you're gonna keep one bill with half a mile and one bill with one mile yes so well if we turn 139 into a study okay so um you can make it consistent with
0443 30. and then that way if we do do a study then maybe we don't need to move the last bill or speed 140 is that okay is that fair just for refresher I can't remember did any of the comments come in whether they recommend half a Milo one mile from any about the recommendations for development um who's a few D wears open oh yes um just I'm just curious will always be more appropriate that is you need to come and speak into the mic because we are on YouTube as well good afternoon Katia valenciano opsd half a mile would probably be more appropriate that is usually the distance the furthest distance from a bus or a rail line that people can reasonably walk so that is usually the distance okay I'm fine with it
045we can be consistent with language in fields thank you so then again to for example 139 the recommendation will be to pass this measure with Independence again converting it to a study recommending sites for 100 000 units of houses within a half mile alternations with a budget of five hundred thousand dollars and conducted by hvha and so any questions [Music] thank you okay for the committee on water and land on sv-139 is to pass with amendments any discussions members on carrying on Vice chairs with a boat um cheers committee's recommendation water line is to pass sv-139 with amendments charitable Side by Sherwood's eye Senator Chang aye Senator McKelvey yes Senator Favela is excused and I'm sure the measure passes with amendments great thank you our next measure is Senate Bill 330 relating to hhftc so
046um Sheriff's recommendation will be the passive amendments and we'll take the department of the Attorney General's amendments to um amend the Proviso at subsection a the new section being added to chapter 21h by section one on page one lines 11-13 provided the right of first refusal should be triggered by her post development or proposed transfer of any fee simple or reasonable property interest in lands uh deleting including any leasehold interest also providing hhftc with advanced notice of any proposed development or transfer of property interest by inserting a new subsection B on page one line 15 to reduce follows any state department or agency shall provide the corporation with say 60 days Advanced written notice of proposed development or proposed transfer as described in subsection a and also setting a deadline for hhft seats or four
047votes right first refusal by amending current subsection B on page one lines 15 to 16 to be redesignated in subsection C and to read if the corporation does not extend the right of first refusal for the proposed exercise the right first refusal for the proposed developer for post transfer within 60 days calendar days of receipt of notice from a state department or agency in addition we have technical non-substantive amendments for the purpose of clarity and consistency from SMA and the chair will also be recommending that we exempt Aloha Stadium from this measure given the plans that are moving forward under this Administration discussion uh if not so for the committee on housing instead of Bill 330 the recommendation has to pass the commitments to your Mozart five members president chairs I vote is there anything
