001and we'll stand and we'll do our pledge of >> allegiance to the flag of the United States of America and to the republic for it stands one nation under God indivisible with liberty and justice for all. >> Thank you. I'm assuming we don't have any public input. So then that brings us down to the purpose of the meeting which is decision on pending litigation and I'm going to turn it over to the director explain what our options here are for the vote. >> Sure. Um, we met with Ben in executive session. Uh, went through about 30 minutes or so with him of the case and um, Mr. Bennett, as he stated, we've got really three options. We can pay what the judge ordered in the settlement. we could offer u authorize a certain amount for
002Bennett to go back and and negotiate with the attorney a settlement. Um in that decision you would need to say um we offer set amount of funds for a settlement or uh if settlement's not accepted we wish to appeal on to a higher court or you can vote tonight to uh appeal directly to a higher court. >> All right, you heard the decision or the choices there. Is there a motion? >> Yeah. >> Mr. Chairman, I move that we appeal the decision. >> Appeal the decision to higher court. >> I'll second that motion. >> And we've got a second. Mr. Harvey. All right. Discussions. Well, Doug's nice to um I just >> I I just feel that, you know, based upon the what we heard in executive session, um based upon what Mr. Bennett said
003and based upon, um the responses from some other attorneys uh who are familiar with the I didn't discuss it with anybody, but you know, attorney. I guess Mr. Benn talking about it. I I think the judge in this case made a mistake and I believe we have a better chance at a higher court. Thank you. >> Yeah, I think that uh my concern in this kind of a ruling is the precedent that it's going to set forth moving forward. Um and which I don't think is could be beneficial for not just our district or our county, but all counties and districts in the state. >> Anybody else? All right. I'm I'm going to concur with what Doug and Paul have said. So if there's nothing else and we'll proceed to vote on the motion to
004appeal to a higher court. All those in favor of that motion show by raising your right hand. That would be almost 74 zero against the motion to appeal by higher court then passes. Now that gets us to the adjourn. Is there a motion to adjurnn? Move to >> second. I'll second.
