001okay good evening everyone welcome to this august 2nd special meeting of the bay city isd school board of trustees we now call this meeting to order just a reminder the meetings are open to the public public comments but comments are limited to items on the agenda for special meetings only and then if you have any other comments outside of that you can make those at regular meetings we do have six trustees in attendance tonight and so we do have a quorum present and we'll start with audience with patrons agenda items linda do we have anybody sign up anybody's just sign up just now on the way in okay item three first reading of proposed revisions to policy be local and so you all have that [Music] 300 wing mold remediation our presenter is thomas caldwell

002the director of maintenance and facilities thomas how are you doing how's everybody very well everyone's really excited hey [Music] just a little background a couple of days after summer school and did you notice some old [Music] test we did a few things a mold consultant their job for their certification is to write a protocol to the mold remediation subsequently brought in another consultant today just to verify that the first one consultant is on even level pretty much the same results same type of remediation so the mold consultant came back and said okay you're two different types of mold that you have growing the levels are so high it's very far it's cleaning in this particular case it was removing discarding all the cinnamon towels carpet profiles lower two feet of sheetrock all the rooms all

003of this should grow in the bathrooms i didn't scrub down all the furniture walls and things like that it also required full cleaning of the hdac duct system and bringing the air straight to the tackle scrubbers for three to four days one year and the other half of that is we have to hire a contractor to come in and rebuild everything so the descent from the second mall consultant today was it's going to be the same maybe the only difference between the two consultants is the first consultant to tell me what he got the cause of the second consultant today he came in with some equipment to measure humidity and kind of as expected depending back on me to the ac system so i know the last year we haven't had controls and what happened

004was when we had that hard two weeks of rain but it would not stop raining the system pulled in humidity and it cannot get rid of the humidity that was in the building so we had a lot of water build up moisture build up on walls the floors less the mold and couldn't draw the system so that's where we're at i want to show you all a couple of plans on what could be done so option one is to go in and actually remediate according to the protocol set forth by the mold consultant the mold remediation company is black and mooring have tasted use them in the past so this is him going into full-on remediation this is a process set on by board this is about to exceed price on there we'll say 399

005000. and then have wiener and jacobs come in and rebuild to try to match the interior of the new school and come back in with the same tile wall color etc 707 000 and then of course [Music] and although the roof doesn't have anything to do with this project the roof is about 22 years old and we'll need to be replacing it seem to make sense here and spin this power line to really be inside you need to go ahead and replace the roof as well option two stared down build a new wing with six classrooms a six classroom lean i think 1.6 million to build a brand new so 1.7 million so for 500 000 more and then option three is to build an ancient room which is about 7500 square feet or an

006additional 400 000 at about two points this is what we've been discussing early how to move forward after you move forward with say option two or three we still have to go in and clean only the personal effects of the teachers textbooks computers small costs but these are our three options is [Music] six six classrooms versus eight classrooms just wanted to give two different um right structures it's probably a question better pose for the principle who's here but we talked about it um just put michael on the numbers in my head so that may get a little dangerous uh we could possibly you can probably get away with with six classrooms with some of the other spaces in the building but if we're going to do it i would say overlapping it just gives you

007more option taking what spaces out of the current new tiny homes what would be taken to provide the others because that's what we have to do our teachers had to realign right they have already started moving into the new spaces in the building with that being said we had to take over the science labs we took over our steam lab we took over the art room the music room is open for a motor lab and then it leaves us one big space right now in case i have to make an extra class and that's what our class is sitting at 11 typically we have 12 classes in each grade level but right now i have 11 and third 11 and 4 11 and 5 so we were able to to do that but typically i

008would have three extra classrooms that i wouldn't have had before out of the four that you're using we have right now so are we only last year we only used 11 we used 12 of them last year and we actually we used 14 of them because one was used for our dyslexia rti um and that's where she served as students and then one of them was our fault where we got to send our students to okay so why don't we have a quote to if we have 11 classes i think the feeling was we had a couple extra classrooms in the new part of the building and scale down but if we do that and right now we have all of our schools built in a way where each grade is in life will mean

009so if we only build six classes then some of the third grade or maybe she would change it i don't know but some of that grade is going to be dispersed throughout the rest of the school yeah so actually we had that discussion among this staff if we were to have taken third grade and just placed them they would have been upstairs downstairs there would have been no consistency after discussion with the whole staffing and the leadership team feedback they've actually kind of realigned into content areas instead of grade levels something unique and new that we're going to give our best shot it kind of gives students access to third fourth and fifth elar third fourth fifth math really content rich always we kind of had to get a little creative with the situation that

010we were in but the team really had some great feedback for the options that were presented to them for that typically you do see that the grade levels are separated but part of our feedback from like our organizational health was that it tends to be a silo third grade is their own team fourth graders their own team fifth grade's their own team so it kind of gives us that option to be in that building and some of the feedback i do have teachers here but the feedback from the teachers they were just really appreciative to be involved with everybody right now i see a benefit for the teachers but for the students themselves isn't that the reason why we haven't kind of separated was from a student aspect like for some fifth graders learned it's

011has mingling so much with the third grader and the bullying and stuff like that yeah i don't know that typically i don't know the point i don't know the discussions of it but for me it's about having them access to content for the realignment it was more about our teachers are all working together they have the opportunity to teach with five other teachers of that same content instead of all the kids being at separate campuses so it aligned our teaching this gives us a really big option for vertical alignment instead of just kind of our our alignment so i mean we had those discussions too absolutely yeah a great benefit for the teachers i just get a little nervous with there's a lot of growth in a child between third and fifth grade fifth graders

012i mean those are some big kids third graders some of them still look like first graders you know i mean that that's the part that makes me a little bit nervous uh how much how much was the roof you didn't have a price so that's not 500 000 more if you did the remediation on the roof it's only 300 000 more just to tear it down build six classrooms correct if we built six classrooms we'd probably be scrambling for space later will eight classrooms be sufficient for us to grow into the future or will we be screening them for space in five years or six years or what does that look like that's a great question so i i'd say yes though and that's just just my hand you have the building where it's built

013with maker space so a lot of the open areas and concepts that are 21st century and not typically a traditional student you have space for that to where instruction can actually take place in the classroom that's why we build the school that way is the footprint of lydia roberts the same as to you it's a little smaller i don't love it totally thinking outside the box just asking the question it's a little smaller is there a potential that we need to shift the grain down to lenny and just keep on saying we have we have a music room that's open a steam room and an art room yeah so if we go with just say the six classrooms which i think in the short term it may work but i think thinking longer to your

01410-year scope you say right now they're in science labs will they be pulled back out of science labs once this wing is complete or once it's whatever is happening to open that space back up or will sign flats now become classrooms if we only do six classrooms i think that it just is gonna depend because it could be that that's like our enrichment hallway and we put science labs down that hallway and if we have it have music and have art have more of our steam program those different types of things in that hallway so that those teachers could continue because the people in our science life are science teachers and we were very specific about that placement um our teachers are phenomenal at coming those classrooms were designed and built for that steam class

015they're not built for a regular classroom so are we shooting ourselves in the foot indeed by not using that as a steep classroom it was it was it was built as a science lab mandy's uh placement of things went into there miss russmans did and so the teachers that are using it are science teachers they have access to all of the labs because of the amount of time that should be spent in science labs we thought that was the best placement for them i do worry about where nathan is going to be this this upcoming school year because she's just a huge asset to us but with covid we saw how we can adjust things and kind of make do for now and mandy has already of course has a plan of action and has

016different options so the the physical layout of a lab versus the physical layout of a classroom it's not much different to where a teacher can go in there and she's not she's like oh i don't have this that classroom has or they have a little bit extra they have extra storage in the back for like um you know their graduating cylinders all the awesome science stuff and then um but they have every um sinks and then but they have everything that a regular classroom does so moving forward we have we did a six or eight since this has kind of made us think outside of the box and you've done such a good job of doing this like kind of vertical alignment would would if you had that other wing even if you had it

017with 12 classrooms would you go back to having advice or would you stay with this new one it's a great question because we've never done it before the research that we found is it is the vertical alignment is going to be huge for our kids and giving them content rich hallways but it may be something that at the end of june we go back and we talk with the teachers and they're saying no we the transitions were too hard and this was um a certain thing and and i think we'll just have to adjust with that i do think sometimes that when we make changes like that we have to give it a little bit of time to see if it's going to work so it's a little hard to predict what i might do

018but i'm not sure yeah that's yes that we have to do is modify and adjust and uh i think these ladies are doing that so when we have thrown a curved ball we learn to modify and adjust so uh we appreciate that uh so to answer your questions and i know it's like i don't know i don't know but we learned a lot about this so thank you for [Music] you said the reason that it happened was the ac problem so there's no liability here from the construction company and that melee that happened trying to get those systems balanced now so in this particular case the ac system is original 22 years ago [Music] the current issue is that it will also interface with controls it's it is a shinier system the system has sold

019and touched side around several times schneider's even have to go back and find retirees that historical controls those controls don't exist anymore so once we lost the interface and we lost the connection there's no there's no fix other than really insulting control it's just all done we'll have the same this is a perfect example of how cutting corners you're trying to save money only benefits you in that year in the next year i'm glad we built the new lenny roberts from the ground up so this was the cost of option one but you're still gonna have all the old plumbing issues or stuff so with this option that was going to happen we're still going to have the old ac docks so the way the system works has chill water and hot water and it

020mixes in each live stream to get the temperatures so each clear each ring has a pad box and it has a controlling nose to it so the computer [Music] valves in each classroom you still have an old system so it's like having a car put in the battery still got no cars in the back so it's a quick question is the system in the homing is it too high so basically this will be almost considered not a huge difference in cost we've already tried to do the wing by building a school and leaving that league existing i think for this district and for our teachers and our students it doesn't make sense to just put a band-aid on an old building not your cost not for the cost of it i mean you're not you're

021not that much versus this when you're dealing with special livestream people that come in with students special protocols special haul procedures because you're dealing with the model versus just staring down and throwing them away so there's a lot of requirements they have to follow when you put people in that atmosphere demolition wouldn't have to take asbestos into consideration yes they do and that's all included in your events in fact the consultant that was there today actually they did the asbestos assembly on that building two years ago which that building was built 20 years ago yes all of that so that's how we started the initial conversation with just to give you some numbers that i would tear the building down and do the whole new reconstruction once again we kind of foreshadowed something like this

022happening uh 2017 just for the clear pack you're connecting a building that's 20 years old with one that's brand new so as we're talking about the systems talking to each other working together that is an issue in itself along with some of the other things that we're having a hard time to control i really truly felt that the price of a new wing would end up being closer to the to the 10 million versus this end so that's the pleasant surprise you need out to the board there's any way i'm looking around for rick if there's any way that we can uh kind of tie some of our our supplemental payments into paying for this if we have to go out and get a loan board and we just set those aside and do that

023because if you tear it down and it will bring the wing down you don't have any of those concerns you have a warranty you need to look in a brand new building for the next 30 years on top of again everything [Music] yes we'll start the conversation and then so what's the current state of the wing itself just uh with the current controls in the new facility be able to be tied in so that we're not dealing with yeah i've got a two-year-old system and now a brand new system uh if we built a milling involved behind the train would be tied in [Music] the only difference you would see is that the mid wing will not have bathrooms in it because the bathroom as soon as you come out the door the bathrooms are

024right here now if you start getting in like 10 and 12 classrooms i think for code you have to add bathrooms but please stick to the six [Music] and if it's vertical line it's this many classrooms and if it's going back it's this many or you know so we won't sacrifice sure whatever program yeah we're definitely not trying to cut down on the programs that we've actually offered at the elementary level so we want the science labs to go back to these science labs we want to find our classes to go back to being that what we've built for that's going to be interrupted if any instructional program is going to be interrupted and we're going to recommend a few more classes how long would something like this take to build [Music] when um talking

025about the new build like our teachers have not been able to go into their classrooms nobody's able to access that way and thomas you i think you touched on it i just want to ensure that if we choose another option that there is some kind of remediation that the teachers can get their personal items like there's flash drives there's you know instructional things some of their diplomas um other things that they would like access to i just don't want it to be in all day so which isn't clean down our weather with new [Music] cost bui in to clean if it's under fifty thousand dollars then i can make the decision to go ahead with it if it's above if it has to come to the board right unless the board's just going to authorize

026us to move forward with just making sure that it gets clean i don't know how much it is you know the first quote before we got the protocol to go and just completely scrub the whole building and engage on everything so okay probably a little more because it's a separate trip but well worth it to get our teachers the stuff that they need to start the school year so with this on uh what needs to come to the board then we'll go ahead and get there will you just let us know everybody yes so would it be worth putting some affordable buildings for classrooms out there while we build so they don't have to switch on so that's an option we have we've talked about um as well i mean i just hate taking away

027the science labs and the arts and the you know that's not they were taking it away but we're able because depending on the board's decision if we know that we're going to go ahead and the board approves by tearing down moving forward then we could possibly get the portable buildings and have the specials out there um until the new building is built because it's going to be it's going to be this year and then when we decide and then i mean it might expect two years is [Music] teacher myself is not a great option i think that they have been very creative in the way that they have done this yes it is not ideal in a bed of roses but i think for a year at this point i think vertical alignment is an

028amazing thing for our students and for our district and i think it's something that i know they have been working on and lisa has been working on and so to be able to kind of move in that way i think is a great thing um do i think long term this is what's best new but for a year i think what you have done and what your staff has done is great for our students yeah and our kids will still have access to all of the arts we we will make that happen they just it will just look very different just like it did last year and our teachers just do a phenomenal job at figuring that out and as long as they are supplied with what they need [Music] okay any other questions thank

029you sir thank you okay item five review and discuss the black cat blueprint our presenter is kelly hunt the district kelly how are you doing this evening good it's very birthday yes um first of all i just wanted to tell you guys that it's been a privilege and honor to work with you guys through kogan i know it's been a tough situation um and it's an ever-changing situation changes daily it changes sometimes and so with that being said i just want to start out by giving you guys you all a little bit of history about where we are right now with code in matador county uh the statistics are about even with texas texas is red if any of you have looked at the code of data statistics for the united states texas our state

030is red and most of the counties in the state of texas are red matagorda county is in all the surrounding counties in our area are red and the community transition transmission level is there's four stages of that there's low moderate substantial and high uh manaforta county along with the counties joining us and most of the counties in the state of texas are in the high range right now the way they get that statistic data is through a seven-day they monitor it for seven days um and that started in january for this cycle and so for the last week in july the 25th and july the 31st um the totals are highly increased for matador county currently this last week we had 45 new cases which is an 87.5 increase thankfully we have no deaths to

031report for the week of uh that week um but the positivity rate um with the testing was 17.82 which was an increase of zero uh 4.4 um with that being said the testing volume however was down so we're testing less people that the volume of positivity is up and so our hospital admission rate for last week was seven for copiod um and then our icd beds are about fifty percent of the patients that are in our icu with coded patients um and then i'm gonna do a little bit of just history about the vaccination status of kind of so that's 12 to 65 at least one vaccine 4962 percent of our population has been reported to have that um with two vaccines for 12 and up it's and then in our population our elderly population

032is much higher which is one dose of 73 and then uh two doses is 64 so moving forward um in may 18 the board voted to remove the map to go ahead and remove capacity to open up for graduation that is our most current black hat blueprint that is on our website okay so that's what i committed so that's our current blueprint on june 2nd we had an executive team meeting here at the edmond building the whole executive team was here and i had gone through um the spoken word and several of the sick authors kind of highlighted areas of concern so at that meeting everyone got a copy of that and discussed it and made some changes at that time uh tba had not presented a new update on june 5th t.a was a

033new public health so all of you have a copy of the blueprint and in the yellow are the things that we talked about in the executive team and something for struck out and then there's some additions and then in the blue are the proposed changes that would make on june 5th per tdn okay and so with that being said um we you also have a copy of governor abbott's bill and so we know that at that time there were there's no more maps the man's mandate was removed and we will continue to follow disney because that's our only option but i i didn't feel like it was fair to anyone not to give the status the status of matador county at this present time just so you have that information once again i'm going to

034pre-interact ta texas department of state health services center for disease control are not on the same age or do i think they'll ever be on the same page however it's our due diligence to make sure that the students and the staff and not only the students and the staff but our teachers in our community stay as healthy as possible so with that being said i'm going to go over the highlighted areas for proposed changes um there are some predictions and additions to the blueprint and at any time if any of you would like to enter some feedback um mrs charlotte's going to be taking notes this is for quote these are all proposals and things you know you all have to vote on them and accept what we decide so we're going to start and

035just go through it um and you guys can follow along i can learn to understand you much better it on daily we took out the fact that we were responsible for streaming themselves daily for symptoms that's at another part at the bottom there's a part about employees that's in that farm another thing that we were a suggested proposal is to remove daily monitoring and temperatures the two temperatures will be monitored upon arrival at the campus and prior to importing these united states we talked about that one before we move on yes so why was that removed was that cumbersome is that why that was removed was it effective or no we never took one high temperature the whole time that we did it all year long never had i never had one on our campus

036coaching them took it on the bus never once they call and say hey this person has a fever they're not coming today [Music] the next um the individuals our student that portion is removed because the new those were from the o maintenance guidance and so all that was marked out and the new is below that okay and so the new mandate is to insert the tda guidelines directly from a public health guidance which states that if any individual who has been in uh school is tested confirmed on code 19 the school must notify local health department in accordance with applicable federal state and local uh laws and regulations including of the confidence disabilities upon receipt of information that any teacher staff member or student from code or consumer minister at the school is testing to

037have cope with the school that's the report must be submitted each day um each monday prior saturday night sunday and healthy practices mass per school systems cannot require students staff to wear a mask ga 36 addresses therapy mandate provide discoveries in response to pandemic other importances are protected foreign in an employment setting that's not necessarily detected by ga36 must allow individuals to wear hands if they choose to and that specifically is straight off of the public guidance any questions there and the rest of it a response to lack confirm cases in the school will continue to do what we're doing the campus cleaning and sanitation uh we're gonna continue doing that um it's my understanding that thomas's uh meeting we set up a journal last and so we'll continue having that practice as well school

038and emotionally means this is a huge issue statewide and we'll continue with all of the same protocols that we followed last year as as we will this year down to the transportation piece temperatures will be taken by by safe prior to uh morning class parents will need to be available if the students can afford the bus we remove that part of the suggestion of the executive team um getting y'all's approval but once again the efficacy of that was just not there um so we were taking temperatures and we were really not catching any kids with the town a rather dismissal and transitioning the district did a really good job of that last year kids were arriving on the campus and we were leaving campus but in this team with the executive team the principals and

039all we just they decided that that was not um effective anymore any questions on that so we had the multiple coins of entrance and kids were coming in in different areas so we were taking that off in the transitional piece the mill service piece the recommendation is no longer for the cdc to have individual package meals where we were doing like everything had to be packaged separately that's no longer the recommendation they uh cdc has found that the transmission level was not being transmitted so we took that off campus this church this was a topic of discussion during the meeting uh one of to limit the exposure of informal campuses will be restricted including during new york times campus visitors will be linked to those essential for school for operations or in support of education

040purposes so that's in addition all day long and that doesn't seem like a big deal to a teacher that makes a huge difference and so that they can do that now right our cares volunteers as long as they go through the correct channels they'd be able to do that field trips will be postponed that this was requested to be removed that's required notice there will be no student assemblies requested to be removed and then any student's social activity must be conducted and open your videos to them participants also such activities regardless of location being compliance with social discipline guidelines and current orders there will be no exception there will be that was the part that we changed in may about the exception for graduation so we're just going to completely do away with that any

041questions on that area [Music] about the lunches would it make any sense at all to where if a parent wanted to come have their lunch maybe they're allowed to but they have to eat like an outside area or something so they don't come into school or is there any way we can give them all visitors coming onto campus we'll continue to screw down the door we did not remove that um and so that's totally up to you guys you all however you want to address that are there outdoor spaces at every campus but still be tough though you'd still have to come into school to say hey i'm here to eat lunches but they all have like those yeah i think if that's how it's going to be then this dude needs to come to

042that area and they go outside to eat and then the parent would check the charter not check the topic and then bring the child back in and then enter but i don't know if there's spaces at every campus at cherry obviously we're pre-k kinder so a lot of pairings of younger kids are going to want to come we do not have outside seating or set outside i think at that point i mean i know what has been done in the past since kinder parents they want to come every single day some of them bring their food they heat it up i mean it's amazing to see how many pre-k parents come on a daily basis i just i think my concern goes to like how do other parents feel about their kid being exposed to

043someone so i liked mr tennant's idea of like or like you're this way about like the kid has to come to that area and it'd be very specific because somebody will say oh so and so come eat with me i brought pizza for everybody and if the parent gets rid of that there's not authority for that i think there's just some there would have to be very specific guidelines i was just trying to think outside the box because i know my kids love that i mean that they could be having some really bad days at school and if you show up with a mcdonald's happy meal then they're please pay yeah i think one of the workarounds that had been done in the past was they sanctioned off i mean we do have some extra

044spaces in our school we're lucky that we have some flex space for the time being um i think that aside from doing that though then we're looking at having to then sanitize and make sure between different lunch periods because we do have a pretty considerable amount of time where lunches are taking place to make sure that those areas are sanitized before potentially new groups of people come in whereas in that outdoor space you do have a little bit more freedom of but y'all don't have that material and i think half of it's probably just my kids but i think at the time to give them a lunch they're more interested in everybody else's special table food look at me and if you do which to a kid they would love that right are we are

045we really at all that concerned about the parents where it seems like we're striking a whole lot of things out about the kids who live with parents so i'm struggling to determine why it matters yes we have some accountability with our kids because they're in our classrooms and we can see what they're doing and monitor where they are and if adults are coming in and streaming in then i mean i've coached so many kids they might just come run up to me give me a hug and i can't stop it and you know that they get back to that kid's parent and all of a sudden so you know unnecessary have reported back in not just the principals but the executive teams i think for now we'll leave it the way that it is and

046if we need to revisit it come december then let's revisit it but let's not strike everything out let's keep a living document right we can go back and change it at any time if the numbers go up if we haven't seen big changes and we can look at it again i would say the cdc's recommendation is still in the visitors in schools to you and bring it back to you in december before the decision ta may make changes next week so she brought that up that just posed a question to me the ta comes back and says hey we recommend students or staff or both wear masks and we do that since there's a governor's order saying we can't do that right so they wouldn't make that recommendation until the order the only way that

047that the mask would come back into effect is if the texas department of state health services if we had an outbreak and they could come in and say this is what you have to do that will be the only thing they could yeah and that would be really touching for them okay but they they actually can they can come in close us down they can come in and say you have to close your third grade i mean they have ultimate power but the governor's work right now employee health protocol moving on all basic employees will be required to complete the cell stream daily at home before coming to work so we're going to take that out and then if you have symptoms do not report it's recommended that all employees um maintain the recommendation that

048was three feet not 60. so that's the change there uh any questions on that we're not changing the intent of bulletin one you're just taking out the requirements actually they're still going to do it our expectations last year was afraid to end in based on the numbers at the time and so we're just saying we're now at that level where it's just everybody activities is going to stay the same and then virtual learner's part all of that stuff is going to be removed because cdc's recommendation as well as dhs and everyone's recognition so kids come back to school in-person school instruction we're going to add all to the students at acid will have the opportunity to attend school and receive instruction via in-person format we're going to just check the day 21-22 and the scenario

049will include a limited instructional platform that involves the use of google classroom um in person construction as well as so it's just google classroom and then the remainder of that um construction will be removed and then we're going to remove the dea health guidance information tv information both bullets down there and then we're adding to the bottom the ta public guidance so that people can stay up to date with that and then just cbc's website so that they can access that information if they so choose are there any questions concerns i don't think we made any changes to your changes right just for your information that was a pretty lengthy meeting with the executive team all your work with us discussion regarding an existing dress code and enforcement and i'll just let all right [Music]

050so little um now about enforcement of policies and if we have a policy that is stated code of conduct whatever it may be that it needs to be enforced and if we're thinking that we don't need that policy then we need to have a discussion about it the reason that i'm saying that it the conversation started about the hoodie and are we going to enforce the hoodies are we not i have children within the district obviously and they don't wear hoodies at the junior high which is according to code they were allowed in the building but then all of a sudden it was a hammer down we're not doing hoodies third nine weeks like if we're gonna enforce it it needs to be from day one so when i was teaching the classroom i knew

051going into a new school year i have to set up the guidelines i have to set up the what we are doing how this classroom is going to run we need to have a discussion about it or the students learning is not going to be in the right environment and effective so i just would love to have a discussion about do we need to do the hoodies do we need all of these things in the dress code because in my opinion if it's in the code it's there for a reason i was not on this board when all of this was put in and so that was my other question to dr scott what was all this put in for do we need all this i'm not wanting to change dress code i'm not wanting

052to change any of that but i am wanting to have a conversation about enforcement because if it's in there it needs to be enforced because what are we teaching our children if we're not enforcing it and if we're not enforcing it then we're really teaching them that it doesn't matter and so is that the attitude we want in our classroom and that's what's best for our students today tomorrow and the rest of their life no i don't believe it is and i don't want my students and my children personally to have that being taught to them in an environment where i expect enforcement to happen if it says so that's really where i stand on it listen we're trying to provide a top-notch education we are doing amazing things within this district we're providing the

053things but this is a little thing but it really isn't just a little thing it's not about the hoodies it is about the enforcement and so i would love to hear what is the stance because if it's in there i would love for it to be enforced because it's ultimately what we're teaching our students and i know that our kids know right from wrong so if you're asking them to do something it needs to be asked day one and it needs to be followed through with and if we're saying well it really doesn't need to be happening then why is it still in there and that's a discussion that we need to have with y'all and it's sitting here at this table actually i do and there's no way that i can put myself in

054the seat that the principles are sitting there um and my my perspective as a principal uh sitting in a school and discussing hoodies it would be independence so the real answer that we actually need would be from the principles my stance at the superintendent is whatever is going to be optimal for them and productive for them and their schools and that's absolutely what i would support so i would post to the principles i know they've had several conversations about the hoodies the pros and the cons and let me just say this somebody's gonna fall on one side or the other there's not going to be the right answer tonight there's just going to be a best answer to support what's happening in the schools right i'll say based in high school it was not just

055harder for the kids but also even our teachers whenever we started school we started getting emails from the teachers saying have you come to our dress code we haven't had an opportunity to go shopping like rides if we were to go shopping we couldn't find places where you can try clothes so we decided as a um as a team of principals that we were gonna have rights and we were gonna understand that it was not as easy for them to go shopping getting clothes so um in the past if you would ask me to do routines every day we need to be professional we need to however others would challenge me and say well they've been in decent comfortable are they going to teach the singers and going through confidence that they did they were

056comfortable and they were teaching and they were delivering to our kids so the same grace that we delivered to our teachers i empowered my teachers at high school to deliver the same grace as well working for the kids and with that pain that sometimes the schools are really hot and sometimes the schools are really really cold so although they um really report the rules that we ask them sometimes they will feel bad that the kids will take off their goodies and they were you know um checking so i i do believe that it's extremely hard to reinforce it and um we had decided i believe we want to implement it next year we want them to have their police as they are similar to the ones they uh to their shirts that they are stalled

057in color but they cannot put it on their head as we just but um that's not an excuse but that is what we did differently [Music] no clothing of any kind with the hood is allowed so by allowing the grace last year did you feel like did you have it run into any instances where it was a problem [Music] um i've got to start preparing my son is not going to be able to wear a hoodie in here because he's one of those kids that wears it in 100 degree weather it's like a combination no it's because they're cold at the classrooms my kids wear them every day i think there's a difference between a hoodie on a sweatshirt that's down and a hoodie that's on the head so this is not about and again

058this is not about the hoodie it's about the enforcement of the policy so if it's stated in this piece of paper that parents get that is on our website then we need to clarify you may not have a hoodie on your head just like you cannot have a hat on your head because i think the enforcement piece of it and it doesn't just go with the hoodies it then goes into all of the other things that we're seeing in the schools and the behavior issues and the choices have consequences so ultimately that's the kid they need to know that choices have consequences and if you choose to continue to put this on then guess what you're not going to get to wear it anymore you're going to have to have something else but it's about

059the enforcement so i think if that's where you all want if that's what you see best is they can have a hoodie but it doesn't need to be on then we let's talk about that and let's change it in our policy and in our dress code because and are there other things in there that right and i'm just i'm just hating that i i don't want the principals to think we're giving you direction right now no no no no this is dr scott's job to do that but most of this conversation even though she's looking there is actually within this board but with that being said i mean the grace versus enforcement policy is certainly worth discussing and so um i don't know where that line is where it gets in the way of education

060and enforcing it gets in the way if you're making them go home and versus the incidental wearing of it right i mean i certainly agree with you right it's a policy it needs to be followed it's not that hard don't put a hoodie on when you go to school right um but if they're freezing cold right they're gonna wear it so the reality is we'll just go to high school you can have classroom eight that's going to be 75 degrees you can go next door and classroom b is going to be 52 degrees in the same field right you can also have and here's where it becomes great because i'm i'm an outdoor teacher and i have one of the students who he comes to class every single day he does whatever i ask him

061to may have something going on at home he's in my classroom he's done all his work he's through he sits at his desk he puts his hoodie on and he puts his head down are we expecting a punch for the assistant principal to walk by look in the window and say well he has his hoodie on let me go and stitch my classroom because if you're talking about some folks who are rule followers and and we're going to enforce it that's going to happen and not only the facts we've done is you've created the situation out of one that didn't even exist because this isn't disrupting the teacher's classroom at all so that's a one-off but those things happen they absolutely happen so when we start talking about like teacher influence and control in the

062classroom and the principles and the buildings that's what i would never project from this seat what should happen at the high school what should happen at the junior high school because really truly those are different places uh kids emotional states are different their physiological state is it's in an uproar in junior high schools but you have to put something in the policy to your point what's going to be manageable for not only the teacher but for the principles and most importantly for the kid as well i said all that to say i don't have an answer and i will support where they want to go how do you actually put it in writing i like to add that a lot of times um not all of our kids have a family so a lot of

063our kids might be sleeping with someone else and i'm going to show up with clothes that are not in dress code many kids come looking for a safe person or a safe place to talk to about what happened the night before so it's really hard to say you're not a dress code you got to go home you know earlier once i wore that hoodie and wear their hats it's probably ten the ones that have those meats are way more than ten exactly i trust them on an everyday basis um [Music] stop you and say take the hell but and i will stop you in the hallways and really take the video but that's me in my own ways and but it may not bother someone else but it would be me in my own ways

064so i would let her ride a horse in where she wants to ride the horse because it's her horse it is your school i was saying rocky was going to rock it and we would support whatever you do it is hard it is very hard we on the outside it is easy for us to say whatever but until you are in that sheet you are walking and it [Music] you know i think that's what jill is saying but we need to change the policy yeah that's not a battle right if it says no clothing of any kind with a hood is allowed for secondary campuses junior high in high school is it this is from the website okay in your board book should be our draft policy and the principles i'm sorry not policy procedures

065dress code guidelines i should say it is not board policy i apologize the draft in your board book has the hoodies uh where it says nobody should have scratched through that while they're in is building that they won't have anything on their i do not believe that's what the draft says discussion one of the reasons why we said that was for security where [Music] and just to be clear i am not for or against honey it is just i would i think that we need to wrap it up and say let's be more specific because i'm not asking a teacher if it doesn't bother her but i'm saying let's let's enforce what needs to be enforced because i think it's setting a precedent and so for our discipline problems for our behavior like let's let's

066make sure that we're put pushing all of our way to let them know like choices have consequences so that is what my whole compass of this is about and that's what started my conversation with dr scott was that i want kids and students and parents and this community to know that bay city independent school district is not going to i'm not going to sit here and nitpick a hoodie or a pink shirt or a what with a bigger than three inch small logo but let's enforce what needs to be enforced because i think that sets the precedent for later and for bigger issues i know my daughter would always complain because she said that most of the sweatshirts that were cool the classroom stuff she said well they'd pull up their headphones and just tune

067out the teacher you know and i'm i'm not okay with that you know but there's something in there that specifically says or not if it's not a security problem if it's just in school and the teacher can say hey take take it off in class i don't that's that's fine but i don't want them in in class with hoods on with earpods during a test saying 3c you know and you have no idea because they've got this big old hood on i mean at the junior on high school level like would it be an issue for teachers to take that on or regulate that in their classroom is that a big issue as far as telling kids take the hoodie off take your hoodie off me you want to allow them to wear hoodies but

068say not on your head like exactly for teachers to regulate i don't believe so i mean right now too like we've talked about temperatures in the different classrooms i've allowed it to where the teachers it's their classroom right so within their classroom that is their classroom but when we leave that classroom and go to the common areas then the expectation is what is in the handbook um we haven't had that issue before where i've been at before too we've allowed hoodies it's just that when you enter the building they do not go on your head this past year it has been a little bit crazy this past year with kobe because we started off virtually we had kids coming going all the time so to really establish that at the beginning of the year was

069difficult the previous year was a little bit easier because we had that ability to do it right from the beginning of the school year stella and i have been having conversations throughout the year about hoodies what was the reasoning behind the hoodies how hard it is for uniforce at the high school because i know it's very difficult for us to enforce at the junior high i would rather have enough teachers who have a kiddo that hadn't been in class for three weeks or been quarantined and shows up that one day with the hood we're not going to send that kid home because i've got that kid there right we're going to stay in the classroom so this past year yes it was more difficult to manage but in the conversations that we had really getting

070down to the root of why was that in the policy to begin with right coming up with the conversations that we have really came down to to say okay it's not actually the garment with the hood on it it's having the hood on the head here in bay city having the ability to find a garment without a hood on it is very difficult or finding one that's affordable is very difficult even to put one on like a student store we have it's not cheap so and i understand them we have it to where it's cold when they walk up to the building every classroom is a different temperature so it's just we've been having these conversations so to have it to where it's just that you don't have it if you hit the building comes

071off your head you is that what the proposed policy says that's what we had discussed that is what mrs moyes said she said that she was something that was supposed to be in the word book i think she was trying to get a copy of it for us yeah i mean i just don't want to burden the teacher but if it's up to the teacher whether or not that could be in the service or not whether or not he or she allows them to wear a hoodie i mean because a lot of times they don't have any undergarments underneath they just put on a hoodie so you don't take off their hoodie right well i'm sure that was one problem the other one was that um by taking off their hoodie now they're going to

072be cold so if you tell them to take off the ability of their head i believe that it will be much more manageable for our teachers just to clarify our new dress code is going to allow studies in the upper level classes that would it'd be the same as the elementary because when i was zach roberts we allowed that you know at the elementary level so it's just the same series i think our teachers do a fantastic job i think of a teacher's allowing students to wear a hood and earpods and it's probably going to reflect in their performance at some point so um you guys are doing a great job thank you and thank you for seeing the individuality of each of our students because every single one is different so and phil thank

073you for bringing the point up so we can have the discussion and i think if we're going to put it in there it's great and allow dr stop to manage that for his principles people is the policy stated that we would have a standardized dress that we approved way back when you did the standardization yes but the guidelines of the standardized dress is kind of the demonstrated rig which is what you have thank you any other comments presentation of elementary and secondary student handbooks our presenter lisa webb assistant um what you have just for procedural come to knowledge from a tasby model based on caspy does our work policy for us so they align directly to our policy in the legislative year we get several updates throughout the year as the legislature passes new laws

074and then as you know they went into a summer session so we are even still awaiting guidance right now on some things because of the fact that handbook uh according to board policy it's not a board approved document it is a living document throughout the year in fact i just checked my email this evening and there's a new update but just to let you know these were formulated by a committee appointed by each principal secondary principles we had two aps and principal working on it and then at the elementary campuses we had several agents that worked on this project i think dr scott also sent you an annotated copy that highlights the changes and the guidance on those changes thus far do you have questions that i can answer about that or would you like

075me to go through i have quite a few stinkies with changes so i know that you want me to go through every one that i'm happy to whatever format you want me to if you just present us with a high level update of just some of the major changes if any and then if there's any questions from any board members we'll just open it up then okay sure will so uh the updates that we've received thus far of course we have some updates to the bullying policies uh central 2050 and you will see those um under the bullying policy in both handbooks those aren't major revisions mainly definitions a lot of times in these inputs there's just further guidance as far as definitions and things like that um there's an additional policy revision to senate

076bill 1895 cte notification requirements that we have to notify parents if there is an off-campus work experience available for a program you'll also see in here there are some changes with senate bill 1697 and that's the retention policy that this year only parents can request their child to be retained that's a little bit different and actually we haven't even received the border policy update for that so that's a great example of sometimes the handbook is ahead of tasby's actually drafting the board of policy so i expect there will be additional revisions in that area once we get the board policy revision and then before this school year we're about to start that is correct so would they be able to start school and then retain them back because it has to be done before the

077first day of school that's correct pretty soon that is correct um and of course a principal eventual counselor meet with the parent they review the data with the parent they discuss the research behind retention there's actually a tea website that we've shared with the administrators that they can walk the parents through that discussion in decision making so is a lot of that discussion initiated by the principal uh it it is initiated actually by the parent where the parent requests the retention and then the the administrator and counselor have that discussion with them um some other major changes that you'll see everything in the senate bills there is a new requirement revising the training for staff on dating violence that's included in there you'll also see that there have been some changes to house bill 1603

078about individual graduation committees again that was because so i expect that'll be a one-year change and then we'll receive updated guidance at the end of next year and then you'll also see that there is further discussion of senate bill 1697 and retention policy those are the major changes there were other minor changes as far as wording definitions things like that but nothing that changed the content so to speak um as you all you've probably heard of house bill 4545 that requires an intervention 30 hours of intervention for students we have not received all the guidance in the handbook for that yet so i anticipate that's probably in the update i just received any questions yes um is thank you for your help yes yes ma'am i have read that bill i've read the highlights of

079it it has to do with the teaching of political race theory yes so that did not happen i don't believe according to my document there were any changes about the declaration of independence but the update regarding anything on critical race theory i have not received that update that was not in this task the update now it may be in the one that i just received by email but in this document that was sent to us in july from cassidy there is not an update for them i'm concerned about that because when they talk about taking out black history when they start thinking on what can be taught in school and especially about that's the only time some of our kids get to know anything about that history and if it's not going to be taught

080by school um i'm concerned but that it's not only about black history it's about ancient history anything uh civil rights is talking about anything of people of color right right now i'll be honest mr robertson i'll have to research the details of the field i've seen just a general outline but i do not know but i will research okay can you just let me know your thoughts on that i will get some more information to you and i would call to ask you about it okay thank you one thing i actually said this is just for for legal purposes is it's a field that's passed and that's a school district and as the administration we have to follow the bills that have been passed i would say to the board as elected officials that their

081bills that come out that the entire order you as an individual trustee has some concerns with i would encourage each of you to take an opportunity to write to austin to write to you know during the legislative sessions and let them know how you actually feel sitting here as a local governing body or local guardian official um when you have concerns with bills of that nature or any any type of nature i'm not really sure it's a as a forward um i'm not aware that we've actually had those types of uh interactions with the state foreign trustees but that that's absolutely the approach i would tell you honestly whether i agree with the deal or not when i agree with anybody at this point as the administration we have to follow it and now i

082will tell you from um i know you've actually said her point of view opportunity that would be lisa's personal to one of you and not necessarily representing the administration because as an administrator uh as a superintendent i have a job that i'll actually do and she does as well whether i personally agree with that or not so i just wanted to go on record for lisa to where she's if she gives you an opinion she's not giving you an opinion representing this administration even if i give you an opinion i wouldn't give it to and i know we have another policy update coming up date one 18 from caspy um so i do not know if it's in update 118 because if that if that was passed that would be a legal policy not a

083global policy but we have no choice update 118 they're in the process of writing the notes for districts but they haven't sent it yet so that's all we know at this time okay that may be in there if the perspective says you're reversed it's bound to be in it yeah and as as dr scott said if it's legal policy regardless of how we feel we have to follow that um and i don't know if there's i haven't seen the draft if there's any local decisions to be made seriously now one way or the other that we're going to stop teaching black history i mean that's a very important part of our cultures they're two different things yeah and we can talk about it if we want to but they're not taking black history out of

084the history books um that's i'm not educated enough on the bill to know the specifics of what is being taken out of the group to speak to that not being educated on the specifics do you have any other questions i can answer for you whenever we get um updates on handling stuff like that can we get a annotated version like we did with the black hat blueprint yes the the local statement because i know we got an annotated thing from dr scott but that was an annotated version of the tasmania document saying these are the changes that you should make and where those things were in our document you may not have lined up it's just really hard it's very nice whenever you've got a highlighted with strikethroughs footnotes that might even go through the

085document a lot a lot faster yes and i i do apologize uh mr west the reason we don't have that is we work off of a new template from casbi every year so we don't do the strikeouts but we can do that we can accommodate that based on last year's uh handbook what is stricken out what's changed for you you have the right version yeah i mean it's not the end of the world it's just whenever you get you know multiple words and i don't have you know over 100 pages each and you're like okay i've got to go through 400 pages of procedure by monday that this is the most fun part in fact we would love to have about a 20-page 2022 student code of conduct and our presenter again lisa moya assistant

086superintendent so the student code of conduct is actually a different type of document it required board approval this does income from cassidy in a draft template that will align with our policy actually this year in a legislative year there were very very few changes in this document most of the changes were either definitions or clarification of wording and things like that there were very few discipline related changes in the wall this year in fact i the only one that was substantive was um you might have noticed in your student code of conduct that it is also now this uh uh where it says uh firearm it also includes firearm um does everybody i'm sorry oh changes um of course we in the section that covers peace officers we have of course peace officers not sros

087on our campus and so their duties are outlined in your board policy so we that was house bill 957 that talked about the firearm silencer also senate bill 248 has expanded the definition of e-cigarettes in the health health and safety code and then house bill 785 just amends the code to require a district no later than 10 school days after a change in placement for a student with disabilities that the art committee seek a functional behavior assessment practice any questions is there a motion to approve is there a secondary motion second about trustee westmoreland is there any further discussion this session about possession or fitted items that's just for while they're on campus right at now yeah they're not on campus shall not possess or use like so there's not sure that like that's we're

088not trying to like go i mean it says you'll see earlier in the code of conduct i don't know what page it is but it talks about that the code of conduct applies to on that's your they actually go through every single page of all these documents as a team and then we go back through it you know 95 percent of these documents are the same across texas and they typically stay the same but you never know if you're going through maybe that five percent that gets you caught up thank you and everybody's got a governance book and so i encourage us all to read this and we have set a date for as long as our government since september and friday saturday or september [Music] i know
