good evening i'd like to welcome you to the meeting of the canyons board of education today is may 18 2021 and we are conducting an electronic meeting with no anchor location as has been duly noticed to the public i'd like to this evening i'd like to excuse um vice president amanda oakes who um is not with us this evening and i would like to also just note that vice president wrigley and myself are conducting this meeting um with the help of the district's i.t department and we very much appreciate those good people who've helped us with this um setting up and facilitating the meeting so um the first item on our agenda is a study session item issuance of lease revenue bonds this is the first reading and i will turn the time over to
mr leon wilcox business administrator good evening uh just to check the technology can everyone hear me okay that sounds like a yes okay good uh welcome uh what we want to discuss with you tonight is the issuance of lease revenue bonds and on the call or on the zoom i know matt dugdale with our financial firm stifle is here and i believe preston curtin may also be joining us and randy larson who is our legal non-legal counsel may also be joining us as well i'm going to share my screen and just to check uh hopefully everybody can see that is there being a thumbs up you can see that okay thank you so let me just go back here let me just give you some uh some background on why we'll need to issue these
revenue bonds this is a common financing option for municipalities in utah that includes school districts and counties to complete uh capital projects maybe on the smaller nature of course general obligation bonds are used for the major projects but uh with the weight prices inflated in 2018 and 19 uh we knew we have to look at a couple options on completing their last remaining project that would include glacier hills peruvian park and union middle which we just got started on all three of those so we looked at either just delaying those projects for a time period or accelerated them and we'd have to do that by issuing these bonds as well as looking at transferring funds from the general fund which we'll talk about in our budget update later tonight and also looking at possibly selling
some property as well so uh but back at uh in the december 3rd 2019 meeting the board opted to to go to accelerate this time frame and they and so we knew that we'd have to issue these bonds which we feel is the right thing to do to get those three buildings which were old aging and you know needed some upgrades and so each one has seismic issues so we really wanted to get those replaced as soon as possible uh when you issue lease revenue bonds you have to actually designate the same with geo bonds you have to designate the construction project that you'll be using the funds for and so for us we'll be using it for glacier hills and peruvian park only will we be using our regular gl bonds property taxes and
fund balance to complete all the other projects as well and also some of those funds will be used to complete these these two elementary schools so we'll need to issue somewhere in the range of 35 to 38 million million of these to from these projects we talked about adding on a union unit to the to the glacier hills project as well so we'll need to look at that and possibly go up to 38 we should not go over that uh we'll need we'll be asking you to take a parameters resolution just like we've done with our other bonds and we'll have that tenderloin scheduled for june 22nd we'll repay these expected to repay these over 20 years but we'll work out a not to exceed 20 years for sure but we'll work out a payment
plan to pay those back and we we have to capitalize our interest during the construction of these projects but accepting premium is now is allowed under these revenue bombs where it is no longer allowed under geo loans uh the big one of the big differences between these two in the bottom two bullets there is the repayment has to come from our current district resources which are tax proceeds in the capital fund uh you know these are different than the geo bonds that the public does not vote on only the board does and these bonds move through about a quarter higher rate and you usually don't ever get a triple a bond rating we've always taken a lot of pride that we've always been able to get the aaa bond rating but these will likely be
usually you get knocked down a notch so we expect these to be rated the next highest level which is double a plus uh to issue bonds there's quite a process you have to go through to make this happen and so i just want to update you now with this and also on board docs preston and matt have uh included a member to the board on on this how this goes about and a schedule that we hope that you will agree with so the first thing we have to do is create what's called a little local building authority we'll call it an lba where you have to adopt articles of incorporation and bylaws basically this lba is going to be the last sort and it's going to lease these facilities back to the district then once
we create that and we hope to do that at the next meeting at the june 22nd meeting we'll ratify these articles incorporation about bylaws and also have to select officers for the lba it can be the current board of leadership or there could be different officers however whatever the board selects and then we'll also adopt the parameters resolution with a maximum authorization amount and the maximum repayment terms and an allowable interest rate and also when we do that we'll set a date for a public hearing we believe those two items on the june 8th and june 22 will have to be done in the business meeting but we believe that will take about 15 minutes to conduct both of those in each one of those meetings then when you issue lease revenue bonds you have
to hold a public hearing and we'd like to do that either on the june 13th meeting that would be our preference just to move the process forward or look at the august 3rd meeting as well again we'll work with for leadership on the date for the hearing so this will process will take three board meetings to complete so you're aware of that as we look at upcoming agendas uh then the final slide is in june and july we'll meet with the bond rating agencies like we do with the go bonds we hope to go out to the market in early august to sell these bonds and then close on them in late august as we continue on the construction timeline for our projects there so with that uh before if it's okay i'd like to
ask i know matt is on the line and randy's on the line i don't know if uh preston was able to join us matt is there anything you'd like to add to that then i'll move over to randy if there's anything else from the financial side thank you leo good evening everybody it's nice nice to be with you um i leon it's hard to perfect perfection so i don't have much to say um you did a great job uh reporting there but i i will just reiterate something you mentioned at the beginning that lease revenue bonds have been around uh statutorily i think since 2001 here in the state of utah and they're a very common vehicle for financing these projects and although they the process to create the building authority is a little arduous
i will say that lease revenue bonds are very well accepted in the marketplace and although they do come at a slightly higher cost than general obligation bonds we've actually seen that differential narrow during the pandemic because the bond market has been so strong and rates are so low so the the actual cost to the district and and taxpayers is not as great as it would be in in different markets and so if there were uh perfect timing for this i would say now is is the perfect timing from from a market perspective so that's that's what i thought would be helpful to add leon and that's that i'm happy to answer any questions on on the bond side but why thank you appreciate that your comments matt uh yes interest rates are still low so
we're excited about that and we from the what the federal reserve has said they will remain low at least the rest of the summer as we go through this process and probably through the rest of this calendar year uh randy you're on the line as well we appreciate you being with us for you who just to remember remember randy larson is with gilmore bill he is our bond legal counsel is there anything you'd like to add and then we'll take questions from the board no i think we're in good shape you can't see my face and my smart allegrant but i'd be happy to read the articles of incorporation and bylaws as part into the board minutes if you would like but uh that's being a smart alec apologies doesn't play all over the phone
but uh no i think i think all lawyer jokes right that's right that's right i think you've explained it very well again this is a common financing tool very very common particularly to school districts whose only options for financing capital projects are either an election with a general obligation or some type of lease concept and that's of course what a building authority bond is is it's a lease revenue financing so i don't have anything more to add but stand ready for any questions thanks leon so president king will take any questions thank thank you leon and matt and randy for for presenting us with this information board members do you have any questions uh mr millerberg and then mr wrigley yeah these are just a couple of ticky-tacky questions well i've got a delay here
this is what um i think part of the the first question got answered when he said incorporation and i'm guessing then the type of entity is a corporation and the second is you just say that you're going to pass a resolution to create a local uh lba i'm assuming the lba is then owned by the school district it is yes we we we incorporate under the non-profit act um a statutory creature called the local building authority it's governed by the school board members it's effectively the alter ego it has no assets other than what it may bond for and pledges collateral to the bonds so we need approval from the school board first to create uh this entity this non-profit corporation known as the local building authority and uh we'll file those with the division
of corporations and then come back to adopt the bylaws and appoint officers as the second step do the funds flow through the lba the bonds do however the building authority can take no action that isn't approved by the school board so um where my question is going is who does the accounting and who signs on the account yeah your accountants will should be familiar with this structure it will be reported as a component unit of the school district um it will be the issuer of the bonds and then there will be a lease between the building authority who owns the school facility during the bond period and the district will make lease payments equal to the bonds but the the accounting will fall under the school districts it will not be a separate uh financial
report um for the building authority is that helpful yeah that's good yeah anything else mr millerberg okay thank you mr wrigley i appreciate your presentation uh i think you did a real good job on the what and the how and i'm going to spend a few minutes on the why uh the technical stuff that you put out there first for i understand correct union will not be put under this bond according to this or will it no union will die let's go union will because i know originally our last bond we had all of these schools in there however what we've run into is the same thing that everybody owning a house has run into in the last 12 years my home is doubled or more than doubled in cost uh and i think over
the last 10 years that i've been on the board we were sort of innovative and risky at the very beginning of putting some money during a crisis a downfall in the economy to build several of our early schools but we've literally saved millions of dollars between corner canyons which i believe leon was about 80 million total isn't it yes it was with our current high schools about 132 million uh there are about 120 million 120. is going to approach 140 to 150 million so you can see that there's a there's a really cost savings we did by moving forward with that uh the reason that we had these two schools that were not on the bond was basically because of inflation i understand right well just so yeah well clear they were included on when
we had our bond election back in 2017 so they were included there that being said if we wanted to build those and if we didn't want to issue any of these lease revenue bonds we'd have to delay either those two schools up to two to four years or we'd have to do the same with union middle school delay for two to four years okay and back in 2019 we talked about this well first as a long-range planning committee then we brought it to the board and the board voted back in this we read it had a couple readings in november and then took action in december of 2019 that rather than delaying these projects we wanted to accelerate them and get them done and keep our promise to the community get those get these students
which you know uh there's basically 550 at peruvian park and when we combine bellevue and edge month there's going to be about 650 to 700 there get these students in safe modern buildings you know to further their education and so and then there's also the same with union so that's that's the whole purpose behind them they were always included back in our 2013 bond election but and but just to build those you know would be you would be looking at 20 instead of opening them in 2022 the elementaries would be looking at 2025 2026. yes i'm feeling very comfortable with this and that we said at the very beginning that these schools were seismically unsafe and we were trying to within these bonds to basically get all of our schools up to safety current safety
measures and at the same time we've seen between alterview and the current elementaries that we're doing there's been a significant increase putting off much longer would probably only enhance that um because the cost of for example cost of a two by four is eight dollars now it's gone up 400 percent in the last couple months so uh at the same time like you're experiencing i think the same thing i'm finding and trying to refinance my home i could be saving fifty three thousand dollars by refinancing my home so i think it's a good time it's it's a good time to do this i think it's a innovative way of doing this without increasing the taxes on the taxpayer um so anyway i appreciate that yeah we obviously were hoping to the prices wouldn't escalate at
the pace they are they have but we really want to get these buildings completed so this is the one option that allows us to do that great thank you thank you anything else mr wrigley okay uh mrs nybaur yes thank you my question is in the history of the district would this be the first time that we would have you know formed the lba and and do that process it sounds like that is the case right this is the first time yet you're saying this is a very common um thing to do and school districts have done that in the past um by by doing that at this time do we feel like this would be something that we would do in the future as well or is it just the circumstances of this this
particular point in time with with the change and cost i would say it's more we may look at it in the future we have no immediate plans the main thing is when we when the board in well it's been a year and a half ago took that action we knew we'd have to do this route and we knew it in the summer of 2021 back then that this would be the action we'd have to take when we started these two well actually these three schools the two elementaries would have to take this course of action okay and then my question is the different bond rate the double a plus instead of the aaa is that kind of attached to this type of structure is that i'll let that contact with that but yes go ahead
matt do you have anything to add to that yes that's that's exactly right that uh the lower rating is is tied to the methodology that the the school district's rating agency uses and just by by default they'll always rate a lease revenue bond one notch lower than your general obligation rating it's it's part of their even though i've i've fought against that against the rating agencies because you know it's district dollars right um but uh i have not been able to persuade them otherwise but it's it's nationally uh the methodology that they use for for all school districts and all issuers of these revenue bonds so as far as the risk versus the benefit you still feel like this is a very great benefit and the risk of having the double a plus bond instead
of the triple a is not significant enough to be able to get these projects finished the the primary impact to the district financially is the the interest rate that you would borrow at on the lease revenue bond versus the general obligation bond and being a triple-a rated school district you you get whenever you bond you get the best rates out there and the lowest rates i i would say that a double a plus is still an excellent an excellent rating and i think nationally school districts would be envious of of a double a plus rating but right now your timing is such that investors are very much uh wanting bonds the demand for bonds is very high and because of that it's really a seller's market and the district is selling bonds and that's the
market you like to sell into in which case there's a lot of demand for your bonds and that really drives down that interest rate differential between general obligation bonds and lease revenue bonds so the ti the time is excellent actually on that cost and that rating would would stay with the bonds for the life of the lease revenue bonds however if you were to go out and do another election and issue general obligation bonds these bonds wouldn't affect your gender you would receive the aaa rating on your general obligation bonds you anticipated my next question thank you perfect anything else mrs nybar no all my questions were answered thank you great thank you mrs schill hey um the first question kind of goes along with what holly was saying i'm just wondering i know other
districts in our state have done have issued the least revenue bonds like do you know about how many i'm just curious how common it is sure back in 2018 alpine school district created their local building authority for for similar reasons to complete projects from their election just a couple months ago murray school district refunded some lease revenue bonds that they issued back in 2014 the last time i looked i think it was 18 or 19 school districts in the state have issued lease revenue bonds and i'm i have that list and i'm i'm happy to send that amber if that stuff if that's helpful no i just i just kind of wanted to get an idea so out of 41 districts about 18. so almost half i mean almost half of the ones in the
state have done that um okay my second question is just what is the role of the officers of the lba and do they have any like personal liability there i'm just kind of curious are they just they just don't do anything they're just the head of the head of that good very good question i'll take that one um you participate as a board member of the building authority in the same capacity you do as a school board member so there is no personal liability um and you're entitled to the same protections as you would otherwise to help bootstrap that however the the discretion of the building authority is exceptionally limited the only thing that the building authority will do is approve for this lease revenue bond structure um documents that we would create on on
your behalf as as counsel to the district after that the only the only other discretionary item that might come to the building authority is whether or not to pursue a refunding opportunity beyond that the the statutory role of the building authority is not exist has nothing to do with policy budget or otherwise it's intentionally a very limited uh purpose non-profit corporation good question okay great thank you both for your answers i appreciate that thank you uh mr millerberg and then mrs nybauer yeah look let's make sure that uh there are a couple of things that are perfectly clear by uh issuing these bonds this will make our budget in the facilities area really really tight for the for the life of the uh the bond isn't that right isn't that correctly on correct yes because
unlike a regular bond we get increased revenues because the taxpayers voted to do that this will consume revenues in our facilities budget on an annual basis and so we will not have those revenues left to do the things that we would normally do with those and the thing that i want to make perfectly clear and you know let's not forget the reason we're doing this when we pass the last bond we did our budgeting based upon what building costs were at the time we promised the taxpayers who voted for the bond well and really we promised the taxpayer they didn't vote for the bond as well that we would build certain schools for me it is a matter of integrity that when we say we are going to do something as a board we do
it now would it be a better situation if if building cost had not escalated and we could have built it all out of the bond absolutely is this a better option than reneging on what we said we would do yeah it is and so i'm not a real fan of the least revenue bond but it is a much better option than not keeping our word anything else okay uh mrs nybar thank you just one last question so once we we organize and incorporate the lba i guess at that point it's kind of indefinitely part of the school board i understand it's sheltered as a you know non-profit incorporation but that wouldn't be dissolved right because you you've got to have the lifetime of the bond and then if we refinance the bond right so once
we've organized that is there any point at any time where that would dissolve or that just would always carry forward with kenya school district until the bond is paid off yeah good question you'll make a covenant to maintain the organization of the of the authority through the life of the bond after that it becomes discretionary as to whether or not you dissolve it thank you okay any any other questions or comments um i i have um one question so with our general obligation bonds uh we we were granted the authorization to issue the bonds but they were issued in different you know chunks of of amount would this be one issuance correct yes we'll look at just one issuance for these uh as we'll just need the funds this year as we complete those two
elementary schools and then and then also one of the particulars of this avenue for financing these projects is we have to identify the projects that the funds will go towards and they cannot be used on any other projects correct yes that's correct yes okay and but we know that this isn't enough to fully fund both of those projects so i'm assuming we have the funds from the general obligation bonds also help fund yeah we'll yes we know these two schools gonna cost approximately 53 million dollars to build we'll use 35 of these less revenue bonds to do that percentage that's about a two-thirds of it the remaining third will come from our ongoing property taxes and our fund balance in our capital fund which is would be the bonds which is partly the bonds that
we have issued the general obligation bonds okay so and then um to follow up kind of to mont's point that that it will take away from our capital um levy annual levy uh revenues um so basically we're just taking an advance on those revenues and and um spending them on these particular projects in this in this manner so how how big or how um what percentage of those annual revenues do you think will be directed this this way are our annual revenues and our capital fund is just over 22 million dollars we'll look to repay roughly 3 million of that back so that's 15ish percent we'll go to these these to repay these lease revenue bonds back so that's right now we are using a decent percentage of our capital project fund to complete these
projects as well but uh this will but this but we're basically making that shift once we're done with the three schools we're not going to union uh glacier hillston peruvian park we will no longer need those funds to supplement the building costs but we'll switch that to a repayment of these police revenue bonds so we still will be able to do small capital projects like roads and parking lots and carpet hvac upgrades and and buy buses and technology and things of that nature but as mont said and as you've said president there is a there is a cost to our ongoing capital budget with this uh around of about 15 percent hey great thank you lord any other comments or questions so we will anticipate that this will come back to us at our next
board meeting on june 8th and and at that point we will let's see the next step would be the resolution is that correct to create the lba correct yes okay all right any other thoughts or questions on that okay great thank you thank you all um that concludes the item um that we had on our agenda for study session so we will take a break and we will reconvene at seven o'clock for the business meeting thank you thanks matt and randy thank you for being here thank you yes thank you i'm sorry i i meant to to recognize that we really appreciate the advice that you give us and and helping us through this this new step that we're taking thank you thank you so nancy did you plan a game of bingo or something
during our break no i guess we built in some time for um plenty of questions as well as if there's any technical difficulties so right this is unusual we never have extra time i know so let's enjoy it oh we are still live okay well for the public yes we are going to enjoy a little bit of a break and we will tune in again with you at seven o'clock with the business meeting uh foreign ready good evening i'd like to welcome you to the meeting of the canyons board of education today is may 18 2021 and we are conducting an electronic meeting which has without an anchor location which has been duly noticed to the public this evening we'd like to excuse vice president amanda oakes and welcome those of you that have joined

values the input from canyons district students parents employees and residents while not required to do so by law the board often designates time in meetings to listen to the patrons of the district i will briefly review a few guidelines for addressing the board patron comments for part of the public record of the meeting patron comment time is limited to residents and current employees of the district patrons may provide board members with written documents pertaining to their comments these documents must be submitted to the board secretary and we asked to do so by noon the day following this meeting and um time a lot of her public comment is at the discretion of the board president tonight we will be able to accommodate everyone who signed up to speak to the board individuals will be given
two minutes and those representing a group of three minutes and um and we have the patrons will be addressing the board through the telephone system so um in a minute i will ask the secretary to unmute the phone but i also would like to remind the board and the public that the board of education does not discuss matters which are not on the meeting's agenda nor engage in public comment on personnel issues of a district employee's character professional confidence or mental or physical health if a patron wants to comment on personnel issues the board requests that those comments be submitted to the board in writing if a patron verbally comments on personnel issues or any other matter the comments must be civil and refrain from personal attacks insults defamatory or slanderous comments about an individual
so with that um i will ask that we unmute the telephone line and first to address the board we are now unmuted thank you okay so first to address the board is tracy henderson representing a group and then amelia mcnamer and following amelia lisa bruns and so uh tracy you will have three minutes and amelia and lisa will have two minutes okay all right we don't have tracy on the line yet is amelia on the line yes amelia are you there okay go ahead please yes amelia we can hear you okay um hi my name is amelia i'm 10 years old and i go to bella vista elementary i'm here to talk about why we should still have maths on for the last week of school all the students in the school district have had
mask on for the whole year it helps protect this but mostly it protects the people around you you could have covered without knowing it without your friend and you have kobits they could go home and give it to their family when you're wearing a mask you're not breathing on someone you're breathing into the mask it's easy to wear a mask kids are used to them we've worn them all year and sometimes they forget to take it off after school students do not need to see teachers faces it doesn't help them academically learn all teachers have a microphone i've made a perfect relationship with my teacher i can look at her eyes and i can tell what she feels you really don't want me to see the bottom half of the face i know the year's
closing has been hard but if we take our mask off now the numbers of positive tests could go up do you know how the cdc said we could gather in groups if we had our vaccine and if no one in our household is sick well no kids in elementary schools are vaccinated only teachers last year i was being able to do field day because of clovis this year i want to be able to do field that unless all of us have enough because my parents don't let me you might think my parents are horrible in me but they are just trying to protect me i agree i think you should have all schools in canada school district wear math so we can be safe and have a good rest of the year thank you lisa
bruns or oh tracy tracy henderson is now on on the line so we will tracy henderson is representing the group so three minutes yes miss henderson good evening board member can you hear me yes we can okay thank you i apologize i was having trouble getting in technical difficulties um i just wanted to say thank you very much for all your time and energy that you put into the school all of the schools in canyons district i'm personally exhausted and i can't imagine how hard it is for you to do your jobs and do this so thank you um i just wanted to report uh some good news i was at the educational committee meeting at the capitol today and i had the honor of speaking in that committee and we were able to address
hb1007 which was presented and voted on and has made it out of committee and it basically takes the maths off kids so we utah parents united was thrilled to be a part of that democratic process and i just wanted to share with you one of my favorite parts about it was that we got to hear both sides of the issue and it made it out of committee 16-7 so um that's going to go into the legislative session which is happening tomorrow for i believe a full vote i also just wanted to share with you and ask you respectfully and kindly to please do not apply for any funds for critical race theory that are coming down from the federal government the public comment for that on the federal level closes tomorrow and then the bill
will the law will pass i do know there are federal other bills coming but if you folks simply just refrain from applying for those funds everything will be fine and um i can tell you that across the state of utah what's happening is parents are calling up and saying are you teaching critical race theory and schools are saying no we're not teaching critical race theory when the question should really be what are you doing to teach social justice equity and using different words so if you don't understand what critical race theory or what the impact is utahparentsunited.org has a ton of resources for educators and board members and i'm happy to share more information um so that's all i had for this evening and i and i do again thank you and i'm sorry that
you cannot see my smile mr milberg because this is a telephonic meeting but thank you again for your time and for listening thank you lisa bruns and then nancy nichols all right thank you board members um on the agenda for later tonight is a review of the document which contains all of the district and state requirements and recommendations that were put in place for opening schools last fall i've also reviewed it and here's what i think when you first reopened the schools there were a series of unknowns and the districts implemented whatever they could with the best intentions of keeping students teachers and staff safe and parents went along with it for the good of the community but in being overly cautious we all got some things wrong so before you review that document this
evening and possibly take action i'd like to take a look at the facts and give you some food for thought as you plan for next fall what are we descending against now and who are we trying to keep safe our teachers are vaccinated and can't get the virus or spread it nor have to wear masks now according to the cdc we've known for quite some time that the risk of complications for healthy children is higher for the flu compared to covet 19. we lost one child in utah from coved while on the 2018-19 flu season we lost children and we didn't require math then even though the state of utah has now met all the thresholds required for terminating public health orders and the vaccine is available for all high-risk groups governor cox has stated
that schools can keep the math mandate if they want to and while i appreciate that you are going to let the kids go mass-free the last week of school it is a little too late and frankly i'm concerned that if peace counts go up again next fall that you will think you will have the authority to require our children to our mass again is there any scientific research that actually shows mass or effective a 2015 randomized controlled clinical trial conducted and published by the british medical journal comparing cloth masks with which most of our children wear to surgical masks found that cloth mass resulted in significantly higher rates of infection than surgical mass and even no mass at all similarly the center for infectious disease research and policy published a paper seeing cloth and surgical
masks do little or nothing to limit spread of the disease because of their inability to keep out the tiny airborne particles responsible for transmission of the coronavirus parents have put up with these arbitrary fear not science-based requirements for long enough as you plan ahead we're expecting you to come to logical conclusions based on actual data and recognize the right of parents to make their own medical decisions for their students thank you thank you nancy nicholls and then brynn white church two minutes yes two minutes thank you for taking time to listen to me um for many years the schools ran their programs and drug-free hoping to have our children be fee and i've been so surprised that they've wanted to push students towards an experimental vaccine a friend of mine wrote recently that her 16
year old best friend was in primary children's hospital from may 3rd and this was written on the 13th with abnormal swelling in his lymph nodes which then led to blood clots in his brain the swelling occurred after his covet vaccine the last week of april and the mom would be appearing before a large group of doctors at st mark's hospital to tell them about things with a copa vaccine the 17 year old is an elite athlete from corner canyon with no known prior conditions so i would plea as a parent that we please please do not request for students to have this i'm opposed to the vaccination clinics at the school and a requirement of an experimental vaccine i do not send my children to the school to have medical procedures forced upon them or
practiced by unlicensed people and not people that i would choose myself anyway i also am requesting an a no vote to the critical race theory and thank you for your time thank you brian white church and then uh tona davenport we're in church and i have children in the canyon script to an elementary at bella vista and one at butler middle prior to this school year my children were enrolled in the salt lake school district we had already made the decision to move our kids to canyons district before any of the 2020 real plans were announced and i have been so grateful that we had made that decision i want to thank you for giving us the freedom to choose how we wanted our kids to be taught this year it felt really good to
be given back a little control in a year when so much had been out of control as you look towards next year i ask you to continue to let parents i know things have gotten heated and contentious these past few months and it's because we as parents feel like no one is listening we feel like no one is allowing us to speak up and choose what is right for our own child what works for one child does not work for all children so let's please do away with these blanket mandates the masks have taken an emotional and psychological toll on my children each one has suffered from anxiety stress and panic attacks throughout the year they are so incredibly excited to take their masks off next week and i'm so glad they will be able
to finally see their friends and their teachers faces please give us the choice for next year if there are families who feel more comfortable wearing masks in school let them but if there are also families who feel safe allowing their kids to attend without math let them please give us our choices back and i hope we can finally begin to heal from the turmoil of this past year thank you thank you tona davenport and then liz miles hi this is tom the davenport um i didn't hear if you said i could go ahead oh yes please go ahead tana okay um i'm a parent in kenyan school district and one of my children um kept getting sent to the office because he would try to breathe and while he was there they would lecture him
and tell him how you know he didn't care about his teachers and he had compassion for others and if the propaganda was around him every day i finally had to pull him out to get the abuse to stop and in the last few months i've had to pull out another one of my children and we you know stanford just released a study showing that what we've always known um that math do not work yet this you know this is a time when everything around us seems to be you know black is white white is black and you guys are in the middle of it master serving their purpose they are we've seen it even tonight they are indoctrinating our children our children are pointing out hey those kids over there are breaking the rules you
know where else this has happened in history where children tell on their parents for sympathizing with people who don't carry the proper papers who have we become this is about the children the politics and the religious pharma need to stay away from our children's education children should not be in math they should and i agree with the lady that just pointed out that they shouldn't be administrating you know poisonous experiments in our school these are our children there are kids in the hospital there's other kids all over the country that have died from the vaccine already that are under the age of 18. we need to stop the code with testing it's just a joke the maths don't work and vaccine requirements this is crazy this is absolutely crazy just go back and look at
h1n1 they wrote books about how it was all just crazy and we're just doing the same thing again making a lot of people rich and no one should be carrying around their papers have you been tested can you play your sports this indoctrination needs to stop and it's happening on you guys watch and i hope that you stop it we should let our teachers teach they're fabulous but they're not they're busy birch signaling and testing all the time for these special interest global groups that we need to get out of our schools and not let them dictate what's taught here vote no for crt no to masks and no decoding testing and no to vaccines and please don't do the vaccines at the school school should be a safe place for kids not a place
where okay parents have to worry about who's gonna try to jab and when they're not paying attention thank you your time is up thank you thank you um liz miles and um i believe she's representing region 17 pta and then um brandon wolfe is is after liz miles representing canyon's espn association so each of them will be given three minutes thank you um can you hear me yes okay so my name is liz miles um i am currently serving as a member of the region 17 pta board and i currently have children attending willow canyon elementary school and eastmont middle school and i just wanted to take the opportunity as this school year is winding down to express my appreciation to the school board and to the district leadership for helping our students and employees
through this unprecedented year my children have benefited tremendously from being able to attend school in person and i know that the other options made available have helped many families choose the best course for their students in this time i have also seen the amount of the benefits educators have gained from having virtual learning on fridays and giving them the extra time that they need as a member of the region 17 board i have had the opportunity to see more of the inner workings of the district and to sit in some meetings with our superintendent dr robin i have seen that none of the decisions that have been made this year were made lightly and many late and sleepless nights have gone into doing everything possible to turn this difficult year into a success although not
everyone in our community has agreed with all the decisions made i am confident that the school board and superintendent always have our children's best interests in mind i am grateful to be part of a district where the needs of our students and employees are made a priority and thank you all very much thank you brandon wolfe brandon wolf yeah hi can you hear me yes we can perfect on behalf of uh canyons education for professionals i would like to say thank you to the administration and board of education thank you for another successful school year thank you for the opportunity to come to the table and work collaboratively on the issues and challenges our esp space thank you for the dedication and hard work that has been put into this year's negotiations while this school
year has been tough on assault we made it to the end and we look forward to doing it again next year so thank you thank you and please express to to um all of the employees our appreciation so that concludes the patron comments those that have signed up to address the board and we we think that we thank each of you for making the effort to share your thoughts with us next on the on the agenda are the consent agenda items so i will ask for a motion and in making that motion please read each of the items listed on the agenda i can make that uh mrs schill thank you okay i moved to approve the consent agenda item a approval of minutes from may 4th 2021 item b approval of hire and termination
reports nmc approved purchasing bids item d approval of student overnight travel item e approval of april for financial reports an item f approval of 2021 2022 land trusts and tssa plans which have received signatures from two board members thank you is there a second to that motion i will second that motion thank you mrs snyder and now any discussion to the motion um i just have one piece that i'd like to just point out on the approval of student overnight travel that that those that travel will be conducted according to district policy and as directed by the board to follow whatever the current health and safety protocols are which we talked about as a ward couple months ago so i just wanted to remind us of that so any other discussion to the motion uh
mrs snyder i just wanted to extend a thank you to ms alice peck for all of the work and time and effort she put into helping uh all of us board members reviewed the land trust and tssp plans and as well i just wanted to thank all the principals that communicated with me as i went through their plans and appreciate all the amount of work and effort and attention to detail i know i had some questions and i just really appreciated the process and everyone's willingness to provide information so thank you so much thank you yes that is a it's a big task and and while we're talking about that i will express appreciation to each of each of you the board members for your effort um to review and study and and to approve
those plans any other discussion to this motivation all right see none i'll call for a vote and please uh raise your hand when when you're voting somebody would we lose yeah we lost chlorine okay um well i think we will go ahead and still conduct the vote so all in favor of approving the consent consent agenda items please raise your hand okay thank you um that there she is um clarine would you like to vote on the consent items raise your hand yes you're still on i i'll never say okay thank you all right that that motion passes oh any opposed i think i saw everyone's hands so all right that motion passes thank you okay next on the agenda new business item 7a approval of the 2021-2022 canyons education association negotiated negotiated agreement this
is action requested and i will turn time over to mr leon wilcox business administrator thank you president yes we've completed negotiations with all three groups uh the cea our certified employees our esps you heard brandon wolf just addressed you that is item b and then our administrators item c so we'll ask for your uh approval on all three of these uh uh agreements and we'll do course do that in order here let me just tell you one three things that are common across all three so we won't so we don't repeat those on each one one is our insurance premiums we've had some very good years with our insurance fund it's mainly due to our high deductible plan and are having around 53 of our employees on these plans that has saved us and our
employees uh quite a bit of funding over the last couple years and we do expect more do we see more funding in this current year so with that our insurance committee has made the recommendation to and what we support to decrease the employee share of the premium and at the same time also increase the district portion of the premium those premiums are found on each uh on each of the negotiated agreements for all three groups and with that in mind that will save our employees up to well in some cases over a thousand dollars annually if they're on the family plan and then around 500 to 600 on a two-party plan and in the 300 range on a single uh plan and again those savings the annual savings are there as well as the uh
pay period increase to the employee will see in their their uh in their paychecks uh twice a month so we are happy about that also we also feel like this brings us more competitive with our neighboring districts with our insurance so we are excited about this change there again that is across all three groups the second one is that we've made adjustments to our sick bank policy what this is is we will increase what we call label level one and level two employees are employees who are typically moving out this one year or two years so they will be entitled to 15 days of sick bank rather than 10. so we want to increase that we also want to create what we call an extended family leave item whereas employees receive sick days sick family
days each year and in those days they do not use their reload to what we call sick days uh sick family days can be used for to care for a parent or a child or any family member sick personal days are just for you or you know just for the employee's purpose so we are going to uh when we are requesting implement a policy where employees can switch five of those sick personal days to sick family days to also help out with the extended family leave circumstances and then the third one is what we call the french benefit or it's or no more commonly called the norms absence incentive we have a agreement with in policy with both the cea and the esp's on and out absolute incentive we placed it on moratorium this current
year because of covet and the restrictions with that obviously we didn't want employees coming to work sick during this year we'd like to place on a moratorium for next year as well uh there's obviously cobots the numbers are getting much better but there are still some unknowns for next school year so we will place that policy back on moral climate as well and bring that back for negotiations in a year from now so that those are common across all three groups uh just to move on with agenda item a negotiations with the cea what we have agreed to do is a two-step increment for all employees what we have had in the past is employees coming from another district with teaching experiences are placed on the same step as they come across here so employee
with one year experience at another school district is placed on step one here and so we want to grant credit to those employees so the way that we fix this is grant two steps to every employee going forward uh that will amount each step on our 186 day calendar and that's where 86 percent of our teachers are is a 900 increase so that will be an 800 increase there we will also grant and 1.82 cost of living adjustment that would equate to a 1 225 cola for employees on this so that would be a total of all these employees a three thousand five dollar pay increase for next year uh overall that is about a just under a five percent cost from this year we will also you know grant lane what we call education
enhancements where employees go back and receive more education as well and also i'm going off a summary that is found on board docs i'm just hitting the highlights i will not hit every item there but uh another those are the two main compensation packages there the other one we want to note is that we will be forming a working group with cea to review both the athletic and activity stipends and look to maybe make adjustments for the 22-23 school year these differential or activity stipends have been in place for uh quite a long time so we want to review those and see if changes need to be made there and those are the main eye main uh policy and benefits and compensation for the in our agreement with cea so with that i'll turn it
back to you presenting if there's any questions or possible motion thank you leon and i i will just turn it to the board board are there any comments or questions on this item are there any comments or questions on this item board mr wrigley i just want to express my appreciation to our teachers and also to the administrators that negotiated the contract a couple things that were really stood out for me is we're lowering the employees share on premiums which is outstanding because i know that's been an issue it's the full benefit package and i think we've got to a point within our district that we're able to retain the best quality teachers and also entice the best quality teachers across the country to come here and i'm excited about that we've got a ways
to continue to go but we're moving that direction and thank you for all you've done on this president would it be okay if i just read into the record those on the negotiation team uh representing cea was mitchell attentio from cornwall canyon erica bradshaw from hillcrest heights she is the cea president karen pedersen who is the ceo vice president she is from willow canyon and was also the teacher of the year from royal canyon so congratulations to karen kathy smith from al tara she's actually been an online teacher this year katie wilkinson from alta high and jennifer amy from the jordan unicef and then representing the district was uh dr robbins our superintendent steve diamond our director of hr dan harper our legal director of legal services charlie evans our director of external affairs and
myself so again as mr wrigley said thank you to the cea for uh working with us this year thank you and we appreciate all the work that those teams have done um other comments or questions board on this okay seeing seeing none um we are ready to approve this and um just i yeah i just want to express appreciation and and this is every every year it just feels good to be able to get to this point where we have an agreement and we're ready to move forward with a contract and it's it's a good way to kick off the new school year and so with that i will call for a vote and ask board members to please raise their hands when voting so all in favor of approving the 20. oh i'm sorry
i'm just jumping ahead here thank you thank you steve so with that i will call for a motion i will go ahead and make a motion so we can vote i make a motion we approve the 2020 candidates education association negotiated agreement as posted uh in the cea negotiated summary in board docs i will second that motion thank you so mr wrigley made the motion and mrs neighbour seconds now any discussion to the motion okay see none now i will call for a vote and and board members please raise your hands um when voting all in favor raise your hands okay that's everyone in favor that motion passes so i'm assuming there are no nays on this one so thank you all so next will be item 7b approval of the 2021-2022 canyons education support
professionals association negotiated agreement this is action requested and i will turn the time over to mr leon wilcox thank you president let me just uh mention the negotiating team and we appreciate their work on this agreement uh you heard from brandon wolf he is the he is our facility facilities energy specialist uh he is the esp president this year uh also on their team was robert martin he is our locksmith facilities andrew marcus is the assistant facility manager at bella vista tyler red is the assistant facility manager at jordan high and mary burke is the admin assistant at willow canyon and then on the district team was everett perry our hr director over esp's dan harper our legal counsel charlie evans over external affairs and myself just to hit the highlight again this agreement is
also posted on board docs we will fund step increments to all of eligible employees this will cost about 1.3 million dollars or about a 1.9 percent increase from this current year we will also add a cost of living adjustment of six percent to the base of the esp salary schedule this is far and away the highest alcohol we have ever granted we went back over the years and our highest one before this we believe was 3.25 so uh again big thank you to the board for allowing for granting this increase to our esps with this in mind the uh total compensation package is about 4.9 million or 10 percent above this current year so again we really are grateful for the board and for the esps for all they do and supporting the mission of
the school district a couple of just policy items we talked about this sick leave us sick bank and the additions to these uh sick bank i mean the sick bank one thing that will will be adding is increasing the number of sick days for esp's to match our licensed employees so that will go from seven to nine days and we will also be forming a what we call an advisory council with esp groups in the facilities nutrition services transportation and i.t departments where they will meet with their directors at least quarterly there to go over any issues they may have but again a big thank you to all our asp's for all the wonderful work they've done this year so with that i'll turn it back for any questions or comments you may have thank
you ford any questions or comments mr wrigley you know i want to express both to our our teachers and to our support professionals uh before the year two years before covid we gave an additional funding to our teachers to bring them up to competitive salaries so we can compete nationally and within the state with a promise we would be working with our esps this year that coveted hit so we had to wait and so at this time i think that sort of goes forth going making uh good on the promise that the board made but you know this really makes me feel good in regards to we function as a family the teachers supported this process uh as we went ahead and moved that up so thank you for being so patient both sides and
for for being so much working as uh together as a district district family thank you thank you other comments or questions on this item okay see none i will ask for a motion mrs schill okay i move that we approve the 2021 22 canyons education support professionals association negotiated negotiated agreement thank you is there a second to the motion i'll second that thank you so mr snyder second the motion any discussion now to this motion okay um yeah i just too will echo the appreciation to the negotiating teams and to our support professionals and and i you know i'll just um mention that they're education support professionals and they are professionals they're very good at what they do and they are very important part of our school system so we we appreciate them very much
and and again it's this is a great opportunity to to recognize the their part in our system and to look forward to the next school year so if there's no other discussion to the motion then i will call and then i'll call for a vote and that and ask remind board members please raise your hand when voting all in favor of the motion please raise your hand and any opposed okay that motion passes with um all in favor so thank you okay next item is approval of the 2021-2022 compensation package for canyon school district administrators this is action requested and again i'll turn the time over to leon wilcox thank you again president let's maybe just introduce the teams for as we negotiated with the administrators it was christy waddell the principal at three for
elementary margaret swanneke the principal at sunrise elementary paula logan the principal at butler elementary and tom sherwood the principal of brighton high we agreed and then on the district side was dr robbins uh steve diamond over director of hr dan harper over legal counsel's uh council and myself again this agreement as with the others is found on boardrocks what we agreed to was fully funded steps for all eligible administrators this is will cost about 141 000 dollars for about seven tenths of one percent about half of our administrators are eligible for a step the other half are not and we certainly appreciate all those who have not been with us all those those all those years as well uh we will fund a five percent i mean excuse me five and a half percent cost
of living to the base of the administrator salary schedule again that schedule is found on boardvox we will also find a 1.25 one-time stipend of those administrators who are on the top step as i mentioned there are 63 or roughly half who will qualify for this dive and again we appreciate their you know their commitment to this to the canyon school district we will also increase the nighttime activity stipend uh to on the following the high school principles will go from seven to ten percent the high school assistant principals will go from seven to nine percent of their salary the middle and elementary schools will go from one to three percent of their salaries this will cost about two hundred and seventy thousand dollars at one point six seven over the current year so uh
and again they will also receive the same insurance benefits as the other groups the total compensation of total cost of this compensation package is about 1.6 million or 10 percent about 10 and a quarter percent over this current year so again far and away the best we've ever been able to ground our administrators uh two other policy things that we've agreed to in the prior years but with covet we wanted to continue we had to put a pause on those and but we'll continue to look at those moving forward one is to continue fte allocations to address the issues of equity and possibly english language learners or program impacts such as dli or salta and then also review the current administrative staffing at our elementaries particularly those larger elementary systems that we have in mind
with that uh certainly want to appreciate all the great work our administrator has done in this very challenging year of covet as well as all our employees everyone has just gone above and beyond so again big thank you for the administrators for leading their respective departments and buildings and all that they've done this school year was so with that again i'll turn it back to you because i thank you for any questions or possible thank you board any comments or questions mr wrigley just um i want to thank our administrators this year has been a very very difficult year uh and has pointed out to me uh as i've known before in the past so we have some of them we have the finest administrators in the district and that's been a problem hopefully this
will help resolve that that other districts have seen we have the finest administrators in the state and have tried to lure them away so hopefully with this new uh canyons administrative contract we will be able to retain some of our best and finest administrators in the state here uh so thank you for negotiating this i'm feeling uncomfortable with moving forward with this thank you any other comments mrs nybaur i actually just wanted to echo what steve said i probably could do that for each of these negotiations we've discussed tonight but very grateful to be able to move forward with that and have a more um competitive compensation with our neighboring districts to keep our talented administrators where they are thank you any other comments okay i will this is an action requested item so i
will ask for a motion i'll make a motion to approve this is nybauer go ahead go ahead you want me to read it i was about to yes a motion to approve the approval of 2021-20-22 compensation package for canyon school district administrators as presented by leon wilcox thank you is there a second to the motion all second down thank you mr wrigley seconds any discussion now to this motion um i will i will just also add how much very much we appreciate our administrators and as has been mentioned earlier this has been a very difficult year where they've had to their job description changed dramatically as many of ours of people in the districts did and they just have risen to the occasion and we're very grateful for the role that they play um in
in our school district so if there's no further discussion to the motion we have a motion and a second and i'll call for a vote and board members please raise your hand to vote all in favor of the motion thank you that's everyone any and so i assume noah none opposed all right that motion passage unanimously thank you um next item is the item 7d the 2021 2022 budget review this is a second reading and we will turn the time back to mr leon wilcox business administrator thank you president um just shared my screen screen hopefully everyone can see that is there a thumbs up that it's there great thank you and uh again just to echo what's been said a big thank you to all our employees and big thank you to the board
for approving these uh compensation packages it's uh everyone has just worked so hard this year to get schools open and to keep them open and to continue to keep our students safe as a parent i am so grateful for all the wonderful things that have happened uh this this school year that my two boys have been able to go to school all day every day so again big thank you to everyone who's made that happen we want to just go over our budget another budget update we went over one last two weeks ago at our last board meeting but just hit uh some more highlights last time we focused on some of our other funds our capital and our our debt and our school lunch but this time we want to focus on our biggest
fun which is our general fund also on board docs i we put out there our draft statements of our financials that we'll ask you to approve about our budget hearing coming up on june 8th so you can see those there we'll just hit on those in briefly just in just a moment but one of the things we want to look at is that really drives our funding is our student enrollment you can see the last five years of enrollment based on our october one counts and you can see we had a roughly a 700 drop in students this year mainly because of well we feel like it's all because of covet for varying reasons parents electing to homeschool some some of their kids i was also our kindergarten enrollment was down so we hope to
get some of those students back you can see what we project out the next five years it's always tough to predict just one or two years in events but let alone five years we do see roughly a 300 student increase or expect that next school year and then staying around that for the couple years after that then we and unfortunately we do see a possible decrease again that's four to five years out that we'll keep an eye on again you've it's been written in the paper and the media about the decreasing birth rate in both the state and the nation and we're starting to see some possible impacts of that so we'll keep our eye out on that as our those years come closer let's just hit what we expect to be our revenues for
next school year you can see the revenues going across there we expect to be able to fund 300 we expect we'll be able to bring in some 319 million dollars of life of course this would be our biggest budget ever you can see just uh four years ago in 2017-18 our budget was about 258 million so you can see how it's grown and that's on page 12 of the draft financial statements that we have out there the revenues i always like to see pictures by sometimes can tell a little better story but you can see it by the source here roughly 41 percent of our revenues will come from property taxes uh nearly 50 percent from the state itself and unrestricted funds mainly dubbed the wpu but also restrictive funds such as cte and special
education funding we also was receive about seven and a half percent of our funding from the federal government in our case or two uh uh grant that we received federally we used to receive it used to be under five percent but because of the stimulus payments that we'll be getting it's gone up quite a bit both this year and next year now we're going to move to our expense site and you can see our last three years of expenses the current budget this year and what we will ask you to approve for our expenses at our budget hearing again it's up to 322 million dollars again going from 257 just four years ago in the 2017-18 year again graphically you can see how this looks by function so obviously we want as much of these
revenues going right to instruction right to the classroom right to the teachers in front of our students so nearly 61 percent of our budget is right there just going around the circle to the right there in the red would be our facilities that would be our our custodians and our maintenance workers also our utilities are included in that nine percent our school admin is seven and a half percent of course is the principal in the front office the staff would be our curriculum and our isd our special education our departments that would include our achievement coaches and specialists their makeup about six and a half as well as our student support that would be our counselors social worker psychologists and nurses bj mainly b.j weller's department centrally that would be our id and all the
software on computer equipment as well as payroll accounting and hr transportation would be our bus drivers and then you can see our our district admin and our as well as our community there a little under one percent by functioning going across there again just by what we call term the term object the type of the expense is is people education is all about people it's always been all about people and i think it always will be whether it's a in a virtual setting or in a live setting in person setting it's paying our people that is why we certainly appreciate you agreeing to the negotiated negotiated agreements you just approved there 88 of our budget is going to people that's that's been the typical amount over the last since we've been a district you can
see the other amounts going in the smaller part of the pie there uh let me just review where we believe our fund balance will be at the end there so you can see our 20 20 our focus put a 22 over on that third column there i apologize i'll correct that but uh you can see our fund balance we do show it decrease our budget for a decrease of 65 down to 65 million dollars uh historically we've always been one to three percent under budget on expenses and we expect or we expect our revenues to be what we classify as on budget so we always budget conservatively so we always give departments or schools budget but we always say you have to return some of that back to us and so historically we've always been
in that one to three percent under budget so we do essentially expect to break even in both this current year and next year's budget uh and one of the things that we talked about we hit this briefly when we talked about the lease revenue bonds in the study session that to complete the cost for peruvian park and glacier hills we're also looking at a transfer of the fund balance of 4 million dollars this in 2022 another 4 million in 2023 to do that that was discussed back in december of 2019 however we're not going to make those trans least this year's transfer until we close out the books for 2022 and then we can examine our capital expenditures and make sure we're where we're at and if that transfer is actually needed so we'll have
more information a year from now where we expect to be but again we expect our fund balance it's about 76 million dollars right now and we expect it to be in that same neighborhood even though we do budget conservatively when we close out both this year and next year uh as i mentioned earlier we have our draft financial statements out on board docs you can see three years of actual data our final budget for this year that will we will also ask you to approve in next year's budget you can also see projections for each of our funds going up three years as well and then the other items that we discuss the capital outlay items our debt service our school lunch and our other phones are also there some of those we hit on
our may 4th meeting let me just switch over here to property taxes okay and so what we'll do is we will be within or what we call a certified rate for this upcoming year that means the district canyon school that will bring in the same amount of property tax revenue next year as it brought in this year with the exception of new growth that means new homes or businesses being added to the tax rules so again it's the same amount of money plus new growth and also as we know that values have gone up and keep going up so that means the rate goes down so we can bring in the same amount of money okay so you can see our actual rates for the last two years and you can see how much it
will decrease this year what we expect it to be you can see and we'll we'll send you these items once we certify this tax rate with the county and the state but that won't be until late june this is a projection of where we think it will be again uh roughly a six and a half percent drop in the rate and also we want to note that that jordan debt line as we talked about last time that this will be the last year that appears on the property staff tax statements for our property owners so we're glad that that this is the last year of that let me just show you how a tax statement may we expect it to look now tax statements are mailed by july 22nd by the county treasurer what we
are assuming here is a property or what giving you an example is a house that went from 443 that was the district-wide average last year in 2020 to 474 or seven percent increase this year now you will say and uh it's happened to me my neighbor sold the house and they've got eight offers and it left asking price right we're hearing that all over the state all over our district right one of the things we have to remember is home values are based on january 1st of 2021. so this large escalation has somewhat happened mainly in february and march and it's still ongoing now so we're not so the state uh state tax commission has told us you know you may not see that big increase in this year you'll see it next year but
you may not see it this year assuming prices on prices stay up but again this is just an example and so you can see for this home for this we're gonna think say this is an average home it would it went up 31 000 in value a seven percent increase in the red there you can see how much taxes they paid this year versus last year 18 26 this year with 8 17 78 last year or roughly a 49 increase so even though the home went up seven percent their tax their tax amount went up roughly two point five percent you can see what their value is taxed on there again this is just an example we have roughly sixty thousand property owners out there there's literally thousands of different examples of how this will
be impacted but again it's important to notice that one the district is staying within the certified rate and that we are bringing in no more revenue than we did last year except for new growth and two uh property uh homeowners will see different impacts based on the value of their home and the changes in the value of their home to the changes in the certified rates so uh everyone will see a little bit different change there some will see a higher tax increase some will see a lower tax amount but i just wanted to bring that to to your attention there uh just on the last slide here just on the budget notice again we'll have our hearing at their next meeting on june 8th uh where we'll ask you to approve both and adopt
both the revised budget for this year and there's been quite a bit of changes you remember last year we had actually finished negotiations when we approved our budget and with all the covered uh funds we've received and also approve our original budget for next year the there has to be a public hearing we have to allow for comment and then the budget we should have a complete and posted to the website by this friday which is may 21st that will allow for the mandatory 15 days of public adoption before or inspection before you adopt it and then the certified rate should be completed by june 22nd again we'll let you know what that is so with that if there's any questions i'll be happy to answer those okay board any comments or questions mr wrigley
i just uh i noticed as you were going through here there was a couple things this ending fund balance is 65 million dollars is that our emergency balance or a rainy day fund or what is that yeah that's a very good question mr wigley what that is is that is our after revenues and our expenditures that is our balance there so we set aside various aspects of that we synthesize five percent what we call an economic stabilization slash rainy day fund or five percent of our expenses for the next year that's about 22 million dollars that we've set aside there we've also set aside in that balance money to pay all the post retirement benefits they call it gasby here for those employees who are eligible for that again we have about 400 or so
employees who are still eligible for these benefits and then we also set aside funds for uh again you can see the 4 million there dollars that we set aside for the transfer to the capital again there we still made transfer another 4 million half of that and also funds for supplies and technology and carryovers from the school and also what we have a we call it an unassigned balance where we can use that as a starting point for our negotiations for the next year so that is that's a pretty healthy balance that we have right there when we meet with bond raiders that is one of the first three things they always ask about is where our fund balance is in our general fund and they spend a lot we spend a lot of time
going over the the details with that with them so it's very important to have a healthy phone balance just it's helped us out this year with covet with all the expenses that we've had so it's been a good health that way so hope that answers that question there great well i expect my appreciation to you um it's it's amazing that we've just went through the year that we have and still we're in such good physical shape so it speaks to your accounting abilities and your department that um at the beginning of this last year i thought my gosh shall we keep the ship afloat but we've done an outstanding so thank you for that the other thing i noticed as we went through here one of our attendance is physical accountability every so often some
people say well you know you're spending everything on administration and i noticed in this that our district administration was less than one percent and our school administration brought us up to eight point five percent of our entire budget which is i think is a great uh amount especially during the cove year here um you couldn't run a regular company with 8.5 percent administration so thank you for for keeping that down and and trying to put it where it needs to go give the direct services to our to our children in the district thank you i think you can see that chart there again we want as much of our of our income going right to the classroom right to our students thank you other comments or questions board okay i am not seeing any hands
for ace so i too will express my appreciation leon and please extend it to the accounting department for their amazing work this it um it is such a complicated process and we appreciate everything that they do and and thank you for presenting us with these highlights from the budget um i do have one question for you and you might have said it and and i wasn't quite clear about it but prior to approving the budget it will be made the full budget will be made publicly available on our website correct yes that is correct we'll uh should have that done we hope to have it done by thursday and we'll email out to you and post it on our budget it will be those financial statements there we will do a write-up about a 25-page
write-up with some charts and graphs there as well that will uh include that as well so we'll but the main thing is those numbers there on the financial statements that is our budget and that is what we'll ask you to approve but that is a very good question there and it will be made available on our website during june we do put together a large comprehensive budget book and that will make it available we do that during june and hope to have that done by early july and as well so but the main thing is those financial statements uh that are shown on board rocks now great thank you so the public can review that and prior to the hearing that we will conduct on the 8th of june great thank you all right board
is there any other comments or questions on this item ok see none we will look forward to that hearing and further discussion on the budget then at our next board meeting thank you thank you next item is item 7e review of 2020 21 school reopening plan possible action and i will turn the time over to superintendent rick robbins okay thank you president before we review the the plan um and it's also on board docs uh for those joining us and the public that like to look at it um i too just like to take a second to thank the board for your support and um passing our compensation packages this year as well as extending uh appreciation to to those negotiating teams um i i was part of that process and it was great to
see the collaboration and uh patience um between uh professionals working together for common goals so i want to express appreciation there also i just want to express my appreciation to alice uh and our secs and the board as well for your efforts uh on our trustlands uh plans and and tssp plans um i i don't know uh if everybody fully understands uh you know the history with trust lens but over the years i have seen this develop into just a wonderful partnership between parents and schools and our legislature and how that has evolved and this goes way back and some of you may remember how trust lands even came to be but it really puts resources in a place where parents and school community councils have a direct impact on how those resources are allocated
and it's just an amazing resource and tool that's that's been a big part of utah schools we've watched that fund grow over the years and it's just awesome to see so want to express appreciation to everyone involved in those plans also tonight just want to express my appreciation to everyone who made uh public comments and before i get into the plan um i i just like to uh extend and call uh to everyone in the district i i know uh everyone be you know at the end of the year we're closing in on graduation everyone's emotions are running high and i would just ask that these last eight days of school that we extend a little bit of patience and grace to each other and and mainly uh you know some kindness i think uh
you know in a situation that we've been in all year um i think you know we're all uh very exhausted and and uh tired from all these uh different things that have occurred and and what the pandemic has brought and what the pandemic has taken from us but i would ask uh all of us to just extend some grace and kindness to each other as we close out the school year and really focus on celebrating um all that's been accomplished as we close out the school year and allow our students and our families uh to celebrate this time of year so um so i i've got just a statement that i'll share a little bit about the current uh plan and then ask the board for some considerations on that and then take some questions
um so uh if one thing is constant this year it's change and we found that out last week as utah governor spencer cox changed the landscape of the final few days of the school year with an unanticipated announcement that the state health order would change which we had been operating under would now be altered to lift the mask mandate in k-12 schools and as i mentioned i've come with some considerations for the board if you recall back in july when the state board of education required districts to prepare and submit a reopening plan we did that and if you had a chance to review it as you recall it's almost 50 pages long it's very detailed but we we really couldn't anticipate an end a date or or a termination date for the plan so
before we get to that i'd just like to reflect a little bit on how far we've come since the pandemic in march of last year at the end of the school year marks a turning point for all of us and an opportunity for me personally to thank all of you thank our board uh our students our parents our employees uh everyone in in our school community really for pulling together and meeting the many challenges posed by the pandemic as has been mentioned throughout the pandemic canyon school district has worked close with health officials county state health officials as well as local doctors experts and others really with this aim to keep our schools open and i'm very proud of that i i think right from the start under your leadership as a board your priority
was to keep our schools open for in-person instruction as well as supporting parents choice and options uh to do what was best for their student with online learning or parent-led and i'm very proud of what we've been able to accomplish and just with that a few things that that have occurred we also made a three million dollar investment in uh uh uh technology devices and chromebooks and other technologies uh video cameras and whatnot to support uh our students uh in the pandemic and going forward we also offered as mentioned in person and online learning opportunities at every school across the district on the first day of school as well as maintaining all of our extracurricular arts academic and athletic activities uh were maintained uh from the beginning to really not only support the academic uh
pursuits of our students but also to really support uh their social emotional learning and trying to keep those connections on the safety side to safeguard our schools the district invested more than 1.5 million dollars in cleaning supplies we also invested in upgrading to merv 13 air filters and improving our air filtration in our buildings masks sanitizer plexiglas shields and other protective personal protective equipment for employees and students our nursing staff has worked tirelessly tirelessly through the entire pandemic to identify and notify our families of close contact exposures in our schools and you might recall at the height of our positive cases um and before january first on the health order changed our nurses were we're doing close contact tracings especially in our high schools uh in the hundreds per day so i don't know that
we can express enough appreciation to them um and then as a as the year went on we also uh adopted testing kits we we made those available uh to our not only to our employees but to students through the county health department the through uhsaa and the and the state we also began a test to play and test the stay protocols i firmly believe that these had an impact on keeping our schools open during january before the test estate protocols if you remember we were in a bit of a whiplash effect with schools moving back and forth between in-person and virtual which was uh really difficult on our students and our teachers our staff and so by going through those protocols we were able to keep school opened at the same time we also as
mentioned we kept students engaged in in all of their activities in january beginning early january uh the state moved educators to the front of the vaccine line and we're very grateful for that and since that time we've been able to vaccinate 73 of all eligible employees and that includes 83 percent of our teachers so we're feeling very good about that and we've also worked with county health officials to make vaccinations uh accessible to our el stu students that are age eligible as a result of these safety measures this year i think it's important to point out that not a single elementary school has been required to pivot to online learning i think that's pretty remarkable we know that transmission rates are much lower in our elementaries and along with all of the safety measures put
in place none of our elementaries have moved to online learning this year also six of our eight middle schools also maintain in-person learning all year long and not one csd school has been required to temporarily adopt online learning since january so i think that's been pretty remarkable and that's been very much a team effort in recent days as you know we've also began to open up more as we've been thoughtful about this process we welcome back volunteers back into our schools our high schools have have resumed some of their most cherished traditions like with proms and award nights and other activities and i think that has brought just a ton of joy to our kids and just uh help with their social emotional learning if you think about you know the class of 2020 really
had their year up until the spring this class of 2021 really did not get to experience a lot of those traditions so it's just been heartwarming and and very humbling to see a lot of those activities open back up for our kids and then obviously coming up we have graduation ceremonies and we'll be able to to hold those full go and just experience that awesome experience with our with our kids none of this i might add would be possible without your leadership as a board and this has been unchartered territory right from the beginning last spring and into the summer you know we we really didn't know for sure what was ahead and i think it is a real reflection on your leadership as a board to help guide that ship and to provide that
that direction to the district also along with that i'm very proud of the fact that our community put great trust in in all of us in the school uh district and adherence to these health protocols as hard as it's been um this hard work and trust really has been the the heart of of our success and it's a collective achieve achievement really worth celebrating as we enter into these final few days um and then just over the last few weeks i think it's important to know that since the peak of the pandemic in january uh covid case counts uh in our canyon zip codes have fallen 92 percent so there's been a dramatic decrease in positive case counts as we know and they continue to drop from april 30th to may 13th the seven day
average for new cases has declined 20 percent across our communities we serve and it's also worth noting it has been six weeks uh in canyons uh since a student has tested positive for after following a confirmed school-based exposure so i think that's uh really important and has been the trend most of the year and among employees we have we haven't had a school based transmission in at least 40 plus days amongst our employees so i i think that's also important to know so we have the finish line in sight and that's great and i would again ask everybody to continue to finish strong at this and and to be mindful uh moving forward and and i'll turn some time over to dan in just a bit after i if you'd like to ask some questions
on on the current plan but moving forward and coinciding with the new health order that was issued on may 14th i would recommend that the board consider terminating uh the 2020-21 reopening plan on monday may 24th uh again in coinciding with the new health order i would also recommend that the board maintain uh certain provisions and i've i've got these listed so you can ask these questions after but i think these are practices that could be maintained that would help us maintain a safe environment for our students as we as we finish the the year so uh and through uh summer school so and i i believe that ends about the third week in june but that would be to maintain our air filtration systems uh at the current level they are with the murfr
mirv 13 filters i would also recommend we continue to clean and disaffect disinfect our schools objects surfaces deaths and whatnot i would recommend we continue to provide hand sanitizer in dispensers in each classroom i would recommend we over these uh next uh last few days of school the last week of school that we we do grab and go lunches where possible so with the warm weather starting to heat up i would invite our students and our schools to eat outdoors as much as possible and enjoy the the great weather that's also helpful in lowering transmission i would also recommend that we continue to use electrostatic sprayers in our cleaning procedures that our custodians have utilized all year to keep our schools clean and safe and then i would also recommend that we continue to utilize
outdoor spaces for activities those that last week of school i i know you know our our schools already do a lot with outdoor activities they have field days and different things planned for outside and i would encourage our schools to utilize those opportunities keeping our doors open for airflow also it might be noted that we ran our school air filtration systems the airflow has been set to uh an occupied level uh for more hours than the regular school day i believe that has been very helpful in moving airflow through our buildings and has helped with reducing transmission and then continue to designate entry and exit flow paths with our students and i would also recommend we continue with cohorting i believe that's been effective with students staying mostly with their class and their their grade
levels during the day over that last week of school and then um also i would recommend for that last week that our students if they travel for field trips uh or whatnot that would go outside uh lagoon or field days or whatnot that they at home uh perform just a simple health check with their parents a self-assessment again it's been mentioned you know if our students our employees are not feeling well we would recommend that they stay home and then also i would recommend with our volunteers uh that they would simply perform a self-assessment at home as well with a self-help check before they consider participating at school but we would no longer require a vaccination [Music] card nor testing so that would also cease with the termination of the plan um and then lastly
i would seek direction from the board on signage on as we terminate this plan on the 24th on what that might look like for masks being not being required in schools what that might look like on our on our signage so with that uh president tiny would you like to do some questions now or would you like to have uh dan talk about the current health plan and then we can come back to questions i can do either way um i i think it'd probably be good to hear from dan first and then the board can discuss okay so we'll invite our legal please introduce him okay so uh yeah thank you president uh i'd like to invite uh our legal counsel uh dan harper uh onto the screen to share with us an update
uh on the current uh health order that was issued on friday may 14th dan good evening uh i just want to publicly thank the board for its dedicated service on behalf of all of our students uh employees and patrons as well as thank you for your your careful and thoughtful consideration of the myriad issues that the board faces including the face mask mandate i also want to thank all the students and parents who've shared their feelings and experiences as they relate to the mask mandate i want to make clear that my purpose is not to discuss whether masks are effective in limiting the spread of covid 19. i will leave that to help experts instead my purpose is to review the most recent public health order as well as the statutory authority of the public
health department and the school board as superintendent robbins spoke about last summer pursuant to usbe requirements the board adopted the planning requirements and recommendations for k-12 school openings then in december of 2020 the board passed a motion to adopt inclusion of updated state department of health guidelines into the district school opening plans instead of continually revising that plan so as a result the latest state public health order 2021-12 which became effective may 14th uh what would be adopted and has been adopted into the plan as well as you're aware during the last legislative session um pursuant to uh house bill 294 i believe which was codified in utah code 26-3-30 all public health orders dealing with coven 19 terminated on honor about april 10th with the exception of coven 19 public health orders for k-12
schools the public health order that was in effect at that time was uh state public health order 2021-2 which provided as it relates to mass mandates each individual on school property or on a school bus shall wear a face mask and have provided certain exceptions to that mandate including medical exceptions those exam those same uh mass mandate requirements were incorporated into this most recent health order 2021-12 the only difference between the two is the effective date uh 2021-2 had an effective date that went all the way through june 15th of 2021. however 2021-12 provides uh this order is effective may 2021 and shall remain in effect until the monday of the last week of the 2020 2021 school year um which in canyon school district would be monday may 24th four days before the school
year ends on may 27th therefore the face mask mandate requirements established in myriad public health orders will no longer be in effect on may 24th for the canyon school district as you're aware recently governor cox made some statements in a press conference that are not supported by state public health order 2021-12 he stated that individual school districts will have the option to impose a mask mandate for the last week of school however uh sbho 2021-12 does not contain any such option for school districts instead the order provides such authority to a local health department it states nothing in this order may be construed to prohibit a local health department from issuing a health order that is more stringent than this order there is no similar authority provided to school districts in sbho 2021-12 and to
date the state health department has not uh created any such order that provides such authority to school districts so uh in reviewing the statutory authority it's very clear that uh the utah department of health has a mandate as it relates to the health and wellness of this state utah code 26-1-30 subsection 3 requires and authorizes the utah department of health to promote and protect the health and wellness of the people within the state and utah code 26-1-30 and 26-6-3 require and authorize the department of health to prevent and control communicable infectious acute chronic or any other disease or health hazard that the department considers to be dangerous or likely to affect the public health in other words in other words it is the mandate of the department of health to make determinations about how to
prevent and control the spread of communicable diseases like covet 19. utah code does not contain any such clear mandate for public schools 53g 4-402 subsection 15a provides a local school board shall make and enforce policies necessary for the control and management of the district schools and subsection 20 provides local school board shall do all other things necessary for the maintenance prosperity and success of the schools and the promotion of education um just uh as you're probably aware uh to date in response to uh questions and concerns from certain patrons who are unhappy about the masked mandate uh the district has repeatedly replied that it is following state law and public health orders in other words the district has consistently deferred to our state's health authorities in such determinations so as the superintendent indicated uh when
the board adopted the planning requirements and recommendations for k-12 school openings uh it did not provide a termination date for the plan uh so i think it's important that the board address that uh tonight um to uh make it clear uh when the termination date would be for that plan and as the superintendent has indicated i should the board should carefully review what aspects of the plan should be included in plans for the upcoming school year and any summer program since summer programs will begin uh before the board meets next uh in in june so uh any questions about the public health order or the uh authority of the the uh public health department or board i think i saw uh michelle and mont so we'll start with amber do you want to this is
nightbower yes okay as well as holly all right so we'll go down what my screen is amber than month and holly if that's okay okay so i just want to be clear on what you just said um so you said we really even though the governor said we had the authority to require mass we really do not have the authority in that latest health order definitely not in the health order there's nowhere in the health order that provides any such authority to to school districts and the i don't mention uh the ability to make any changes or anything uh is just for local health departments okay thank you that was my question okay month mine's somewhat up the same alley as uh what am i had so what you were telling me is that we
do not have a choice we pretty much have to take what the governor's mandated and run with it well uh what the the health department i i think you know that's what we've we've relied upon uh the the legislature basically did away with all of the health orders um from the health department with the exception of ones dealing with k-12 during this last legislative session uh thus giving the authority to the health department to continue to to provide health orders for k-12 um and so that's what we look to now the governor i'm a little confused here you tell me that we're looking to the health department because the governor made a unilateral uh unilateral uh declaration that we would do away with mass the last week of the school year and so are we
following what the governor said are we following the health department well i you know when you say declaration he made a statement in a a press uh a press statement a mandate whatever you want to call it well there is an important difference because we have had orders from the government governor throughout this uh pandemic and those are we have followed those orders very carefully um this he did not provide any such order when he made that statement which is the the challenge that he faces aboard because he did make a public statement but he didn't take steps to clearly provide you with the authority to do so which is uh quite a challenge for the school board and i'm fortunate so what we're going to do where he said he's going to terminate that
and we are to have no mass the last week of school will follow that part but where he said we have the authority to require mass we're not going to follow that part what i'm saying mont is that today we followed both the governor's orders those are written orders and we have followed the public health orders from the department of health currently there is no governor's order um there is a public health order i i agree it's it's confusing and it puts the the boards in a difficult position because he made that statement in a press conference but then he did not take any particular action to actually provide school boards with clear authority to do that option holly okay just a few comments i i believe what we saw from governor cox is actually
not that much unlike what we saw from his predecessor governor herbert because oftentimes this last year as i was watching his press conferences there would be orders and there would be a health order that was rolled out but then there would be kind of almost an aside where governor herbert would say but of course we trust the local school boards to make decisions although the decision was already laid out for us so i think there's some similarity there and i think it's because you know um our political leaders are concerned about local representation maybe a little uh or or uh maybe trying to validate at least the appearance of it but of course i feel comfortable in deferring to health orders right as a school district we do not claim to be you know the
cdc experts or that we are you know were experts in communicable disease i know last year my my uh predecessor chad iverson would say we don't want to do fisher price epidemiology that was a coin phrase that was used throughout and so i think that for us to follow the health orders like we have done all year is very consistent um that that we do not want to be in the business of defining um what is best practice for health or to be you know um trying to decide you know what's what puts the public at risk or not that's really not our job our job as a government entity as a public school system is to follow state statutes and to follow health orders to the best that we can and know and so
i feel very comfortable in following this as well a question i had for you was in this current health order i know our superintendent dr robbins made some recommendations of some other protocols that he would like to continue and i'm just wondering what's the current health order with that is that something that they are encouraging as well i haven't seen the specifics on theirs and other things they weren't mandated um by any health orders these were just additional steps that the district decided to follow um decided to use a lot of best practices um and uh by ending the the reopening plan um i think it's important that we address you know what what we've learned during this past year and what we want to continue uh moving forward thank you and that brings me
to my last question so with moving forward say if we we make this motion to follow the health order but to continue certain practices that dr robbins has already iterated would that be then for the for the coming fall and that would stand until we at one point terminated that motion as well would that be correct like i noticed on some of these like you know um when he was talking about sanitizing the bus seat and you know some of those things so that would just continue indefinitely and unless we were to make a change is that correct that that's correct just like this plan didn't uh technically have a termination date and thus the need to do so again we're not sure what the fall will look like whether we'll really have kind of
given covid19 the knockout punch so it really isn't the health risk that it has been in the past and whether we need to continue these practices and and for how long it's kind of difficult to uh you know give it a clear termination day but we we could uh give it to the end of the next school year and if things you know improve much more rapidly and that would be great uh you know the board could could stop those measures sooner than that okay so one of those suggestions was the grab and go lunches so if we were to put that into motion then that would then the grab and go lunches would also be for this next school year it may be a good idea to pull that out
