001good afternoon everyone today is Tuesday January 24th 2023 and the time is 101 pm has the front lobby been cleared thank you we're here today for our school board briefing meeting today welcome everyone does the Mr Ramirez is there anything you'd like added to the agenda or any other comments at this time ah no sir okay thank you we have five items today per bro poor per boat board protocol each board member subscribe for four minutes for initial comment two for follow-up and with a total of 10 minutes during discussion let's proceed to item number one job descriptions and Mr dodig whenever you're ready May proceed sure good afternoon board board attorney and Mr Ramirez I am here to review two job description descriptions with you one of them is a specialist in psychological psychologist
002support and the other is a coordinator in Safety and Security the changes to the specialist psychologist support are in the minimum qualifications and the preferred qualifications and I'm here to answer any questions you might have does any member have any question regards to his job descriptions Miss Morgan please proceed I'm going to ask the same question on both job descriptions preferred qualifications are industry certification in the case of the specialist psychologist support industry certifications are preferred can this be required by a specific time in a job description in other words if it's something that's preferred should not the candidate be aspiring to that now maybe putting it in the job description is not where it belongs but I do believe that since we are in some cases lowering the standard for the employees there ought
003to be the expectation that people will work to that standard and then I would say the same thing on coordinator Safety and Security valid state certification as a safety inspector in Fire and property that's a preferred qualification that certainly ought to become a job requirement so those are my comments thank you thank you Miss Morgan any other board comments up here Miss juvenile what is the scale for for the specialist psychologist support because it says pay grade six but what is that range I can't answer that off the top of my head I can certainly provide that to you I want to do that off the top of my head okay because I mean I think that's important because we're we're wanting a degree associate's degree at least and I think it would help that
004perspective for the you know what kind of candidates are we actually going to get based on how much we pay I mean I think it's important to note thank you're welcome any other board comment or questions Miss Patrica I'm just not sure that we've provided any real feedback I agree with Ms Morgan's comments I'm just did you get a lot of shaking heads from the board like are you able to read that I think so yes okay foreign additional comments myself if you could look into yeah I'll provide the pay grade yes sure so thank you Mr dodig I appreciate it thank you okay next on the agenda is student enrollment plan first reading 22 23 24 for the proximity plan so looks like Dr Malloy will be presenting thank you trying to pull up
005here there you go good afternoon board members this PowerPoint presentation is kind of just like a high level overview of the plan some of the plan changes I will be uploaded to board docs for the public to review the plan has been up but we did want to provide an accompanying presentation that just kind of hit some of those major topics that we've been discussing and where they live in the plan before I turn it over to executive director of student enrollment sereta Ralph I just wanted to give kind of a brief intro timeline and then kind of set the stage her technical expertise on this matter is extremely important as it relates to the plan and the different sections of the plan this is you know the first reading of the plan for student
006enrollment 23 24. this is where our previous board presentations and the approaches and procedures this is where it lives so it lives in this plan this is something that is presented to the board every year and that's what we're here to do today in terms of our timeline we did do a board presentation in August of 2021 where we moved forward on proximity map 4 but it didn't have the accompanying procedures with it so I did just want to include our first proximity update for 2022 and that was July 25th and then you can see the board briefing presentation with the proximity Plan update in September of 2022 our board Workshop presentation which was the proximity draft plan and then last Friday we had the board Workshop presentation the proximity draft Plan update we did
007present yes yesterday so last night to edac which is a part of their kind of ethos as an advisory committee is to look at those changes in student enrollment it was actually our fourth time presenting to edac on the proximity plan and so we received some feedback what we're calling real-time feedback you know so we're taking feedback we're assessing it with our team and we are incorporating that into the plan we do have a DAC presentation and we met with executive Dak last week and then we are coming back to DAC on this Thursday so January 26th for our DAC presentation we are hopeful that this approach with our real-time feedback and the technical work that's been done by a large member of our District staff that the school board will vote on the student
008enrollment plan on February 7th foreign myself and Mr Ramirez have been up here for the past two presentations I did just want to give a big honor to the teams at the district that have been working behind the scenes on this really across the board so while we've been up here presenting and talking about procedures and talking about some of the maps District staff across divisions have been working really hard to make this happen and it we wouldn't have been here had it not been for their hard work so I just wanted to kind of stop real quick and just give a really an honor to those teams that are doing something in the scale of system change that we haven't seen done with student assignment in 15 years so from academics really you know
009from Dr Cuban McCoy Dr Spiro their executive director team communicating and having those one-on-ones with our principals you know that's that's been so important to Student Assignment to to our great surretta Ralph who's sitting next to my left who you hear from in the next few slides you know the face of the plan itself will sit in student assignment right and a lot of times that's our family's first introduction to the school system and the work that they've been having already with our families and our communities and our one-on-ones has been fantastic the frustration the challenges but most importantly the patience and the love that they've had as they've worked with our families secondly it's a group that doesn't get a lot of doesn't get a lot of Kudos and that's really the engineers behind
010it and that has been huge right they meet every single day and I'm talking about our application Services team Daryl Eldon you know Jose Richard Richard Mayer Jonathan Hauser if you've never had a chance to meet these people that are building things behind the scenes they are show they are building how this is going to look and how this is going to roll out they're working with our vendor Focus their having meetings as I mentioned daily so that they can make sure that this runs and operates in a smooth fashion so I did just want to give a shout out to the application Services team the engineers the ones that are that are building what will eventually run our Student Assignment plan so now to the plan itself so the student enrollment plan for 2023
011and 2024 in proximity for elementary schools really lives on pages four through eight so you can see in the plan itself Pages four through eight is really dedicated to that Elementary enrollment process okay our new proximity zones the associated School choices there's a map there's the selection or draft selection page with the different choices associated with the map really our transportation responsibility is clearly laid out for elementary school families and I know in the previous presentations we've gone over what those three student groups are that are impacted right our incoming kindergartners our students at the elementary level new to the district and then Rising students needing Transportation living outside of their current school zone one thing that Miss Ralph is going to touch on is open enrollment and how that is potentially going to look
012and she's you know put together a number of kind of draft enrollment periods one thing that's great with that team of Engineers is that we'll actually be able to run both the grandfathering window and the new proximity selection window at the same time so it will save us time and it will allow them more weeks to actually test the system on the back end which is nice so they'll run them concurrently which is which is something that we were very hopeful for not having to do it in consecutive weeks so I do want to turn it over to miss Ralph and thank you so much for having us up here today thank you thank you board members and Dr Vernier I look forward to sharing some information with you and hopefully being able to address
013any questions you may have because this is our first time as a district and as student enrollment to make a significant change for our district and what is needed for our families and of course for our schools in our transportation department so with the student enrollment process for elementary schools we want to make sure that we let parents know that the students do have the opportunity to stay in their current school if they wish to stay in that current school then we will be doing what we call the grandfathering process those families would choose to grandfather their child but we want to make sure they understand specifically that they are waiving that Transportation if it is out of the proximity or the address Zone those different zones that we've designed if they choose to do
014that those participating families would be giving up that opportunity for transportation if after one school year next school year they decide that they want to you know this is too much then they could go back into the Open Enrollment just like we do all the time and at any time during the school year if the parent decides we can make that change if we have seats available we're always wanting to do what we can for our families the next thing we want to do is make sure that our parents know that our participating families will that are coming in or our new kindergarten enrollments or new families to the district will rank order their schools just like they've always had an open enrollment the difference is they won't have 17 schools to rank that's a
015big plus they also I'd also a difference that they're going to see is if they decide to enroll or move to Lee County new in July they're not going to get a school that is a long distance from their home they're going to be in a school in their attendance Zone which that's a big plus for our families also so we look forward to a big change for our families in something that I think many of our families have been looking forward to our open enrollment process again is something about Transportation because we do have to get our students to school on time and that's something even our elementary students most of our waivers that come to student enrollment are about Transportation the bus is late the bus is not on time the parent has
016to get to work they can't leave a second grader at home waiting for the bus and the parent can't miss work so we want to make sure that our parents are aware that this is going to be a plus for them with the proximity zone so the transportation would only be provided if they're selecting a school in their current address proximity Zone and if that school that they select is in excess of the two miles safe walk area again we will only have a proximity of P1 with our elementary schools for this upcoming school year any of our students that do not participate in open enrollment if the parent just does not submit the grandfathering clause or the waiver or they just do not submit a school's Choice application we need to get those students
017placed into school because we need to see what our capacity is for those schools so prior to running the Lottery lottery we will run a list of all of those students that have not participated in a random application will be generated for them through Focus so again they will be included so that they will have a seat if the parent changes their mind and they want to be grandfathered they would have that opportunity to be considered for that if space is available but we want to make sure that we're holding a seat for them The Sibling preference will remain in effect as Dr Malloy referenced we have a lot of kindergartners that pre-registered for kindergarten we've started this back in October actually right after the hurricane we started that so all of those parents are
018anxiously and I say that very loudly they have tried to submit applications already they're anxiously awaiting to get their school so we want to be able to place those students if they are going to be grandfathered in we'll pre-place that incoming kindergartner with them as long as they agree to waive Transportation if during the lottery as soon as they're Rising kindergarten through fourth grader is placed we will pre-place that Rising kindergartner that incoming kindergartner in with the other student yeah and just to emphasize what Miss Ralph was talking about and in the spirit of first reading I did want to read on on page five sibling preference will remain in effect as in Prior years parents with an incoming kindergarten student will be notified of enrollment with a sibling as she just mentioned with pre-kindergarten
019registration this will occur after the kindergarten pre-registration window closes in late January in the event the incoming kindergarten and current siblings are enrolled in at school outside the new proximity plan map the parent may make the decision to waive Transportation or enter in the lottery for a school within the proximity plan attendance Zone I did want to also mention that we added in based on our real-time feedback that trailing the trailing Middle School piece for our K-8 Academy so our K-8 academies if they have an incoming kindergartner right they can Trail a sixth seventh and eighth grader and they will be provided Transportation as those middle school kids will be provided Transportation until that middle school student matriculates out of eighth grade right and then they will have a decision to either stay as a
020grandfather child in waive Transportation or go into the new proximity Zone again this is your three three year progression plan that you've seen many times I don't think we need to talk about that but again that's just reminding you but it is part of this information that I think we just need to be aware of as the increasing grade levels each year and again is how this could possibly impact our middle school and high schools some factors that we're looking at for affecting our initial School of enrollment is if there are not available seats within a proximity Zone because right now we do not know how many students are going to want to be grandfathered many of our zones attendance zones are very tight they're they're very populated and we want to make sure that
021we're accommodating families but we do have written in our plan that we would transport the students to the adjacent proximity Zone but we do have that written in there and we would provide communication to the families we also have a lottery process for those students that are submitting a school choice application that Lottery process goes into the different preferences which you're going to see on the next slide those preferences are listed for our ese or special programs that sibling preference that P1 preference and of course House Bill 7029 if seats are not available for all students then we look at those preferences to determine which school between the four to five schools within that address Zone which school that student would be enrolled in if they're not going to get into their first choice which
022school they're going to get enrolled in and that's how the random Lottery Works in focus again here is the slide with the different attendance zones throughout the district but with the parent now this is just showing you all of them but when the parent actually sees it in their Focus Parent Portal they will only see their attendance Zone that they will be selecting from not all of them I just want to throw out a little reminder as my little Public Service Announcement we still are pre-registering kindergartners for this upcoming school year we will have to pause that for a short period of time to get ready for the open enrollment for the elementary but we will continue to take that information for families and allow them to put it in their Focus Parent Portal we
023just won't be able to process them for a short period of time I think we're well into probably at least a third of our whole kindergarten population that have submitted their applications through the parent portal so we know that parents are very excited about having that opportunity to submit it through the parent portal it does say on here that we ain't that parents we accept applications via email I told Dr Malloy we would leave that in because we can accept them but we really want to make parents to use that Parent Portal because that is where they're going to get all of their information that's what's going to help them when school gets in session that's where they're going to see the grades and it's a great way to keep that connection going once school
024starts that's a good way to communicate with the teacher so we want to get the parent portal going that way they can upload documents and make changes as needed after the lottery runs this year we hope to be able to open the parent portal to All Families both all grade levels All Families coming from anywhere they'll be able to upload documents and then we'll be able to follow up with them so that we can hopefully get rid of any lines outside of our office additional revisions in the plan other than Elementary we have reduced our wait list previously our elementary wait list said if you did not get your first second or third choice you went on the wait list now if you do not get your first choice you will go on the wait
025list for elementary schools we won't be able to do a lot of movement again because our zones are very tight but we will be able to put students on the wait list that wait list remains in effect through July 31st we also have a few other small changes to our plan we have an additional middle school that's opening this in August that would be QQ in the East Zone and all of our high schools this upcoming school year have an advanced program opportunity they either have the IB Program Cambridge the FGCU program or an arts program so we're very excited about that too and just a reminder that this deck will be uploaded to board docs just kind of an accompanying high level deck for the plan itself okay superintendent comments or board discussion Mr
026chair board members staff has been continuing to work continuing to work through nuances of this particular plan in preparation for the February date we've seen some adjustments regarding next local proximity that probably the first time you've heard some of that language looking forward to your continued discussion and questions regarding the plan and I Echo Dr malloy's sentiments that Miss Ralph and Dr Ralph and her team are amazing down in student enrollment I've appreciated the work of Miss Ralph Dr Spiro and Michael Ramirez who worked pretty hard last summer to try to alleviate some of the congestion that arrives during student enrollment season especially with our parents so anybody who may be listening or in our audience who can tell a friend please register as early as possible do not wait until summer when these opportunities
027arrive let's get that done soon as possible and we'll work with the communications team to continue to drive that message we look forward to hearing your discussion thank you Mr superintendent board comments and questions Mr persons this may have been covered in our Workshop but I don't think so we have several k-8s and if their grandfathered in let's say in in fifth grade do they get to con end but they're outside the proximity do they get to continue into the sixth seventh and eighth yes currently they would grandfather in throughout the KA process thank you another board member comments Ms Morgan so in our last meeting we talked about this is about communication with the parents who don't register at our last meeting we talked about the fact that there would be Outreach before the
028fact before the enrollment period begins and that'll be initiated by the schools now you're talking about Outreach you're going to have to do some kind of Outreach afterwards because somehow families have to be told if their children have been enrolled in a school where they're going to school so how will that be communicated so yeah both the Strategic Outreach prior during and then and then post so those reassignments will be communicated you know we have those lists generated provided to principals actionable and then we'll have we'll see where those numbers you know really land and then we can be we can be really targeted with with the those that didn't participate are now reassigned within the proximity Zone and then those providing those parents the new assignment my concern is that some of these schools
029have a significant number of children who will not be grandfather who who are not in the attendance Zone and I'm just wondering as a district rather than as a school how we plan to communicate certainly about the choice but then once a child's been assigned when they didn't have a choice or didn't chose not to make a choice I'm just real concerned so I'm just that's just my comment thank you Miss Jordan thank you that actually Miss Morgan that actually that comment came up at edac last night as well the concern of communication and how are we getting that information out to the parents for those children several people brought that up regarding that issue so it is a concern for many as well and I know Dr Malloy was there when they spoke but
030I also have we were talking about the very populated areas and for those areas that are very populated that may not have the capacity we would then take that child and take them to the next Zone if we already know that they're over populated Would we not just add them in this and I guess that question I should ask just to clarify on the capacity question so the proximity zones were built for capacity both on the five and on the 10-year side yes they are tight in some cases but proximity was built to building capacity so not to our current program capacity which we are over right so I think it'll give us a more efficient utilization of our buildings and I think that we'll see some capacities at some school buildings within the proximity
031Zone that you haven't seen those numbers at before right but the buildings do have space and the kids are there and then we can properly you know program and staff those schools so while the capacities are tight given our growing demographic right projected in the next 10 years to grow by 28 000. we are set for proximity to to handle that growth within each one of the zones to have enough room to handle the growth now what we don't know and which is the variable is the grandfathering number that's why we did want to add in that italicized be provided Transportation into an adjacent zone so just in case we hit that Tipping Point of 90 percent at every single School of those kids that elect to stay which we don't believe the facts nor
032previous participation in our systems predict that you know we did want to say have in there that we would provide transportation to an adjacent Zone while I do not think that will be likely I thought it was a I thought we thought it was a good secure kind of safe fallback okay and I may be off so just say Bayshore so if Bayshore has x amount of classrooms that have not been utilized this would then allow those classrooms to be now utilized because we've took that invisible line away and have moved them all in the same direction I guess is that am I thinking right or yeah so proximity will will fill the school based on the number of students that they can hold so a lot of our schools are at their building capacity
033right but some schools are not so it will maximize that it will maximize the use okay thank you any other board member comment or questions Miss Patrica thank you so this is more of a comment if I made to the superintendent it's super helpful for me when I'm looking at these plans or documents that we need to approve each year if they're redlined so that the changes jump off the page at me having been here for six years I don't want to reread what I approved last year I know we have a student code of conduct coming up so I just wanted to bring that to your attention please Mr chair and board members it is an Avenue which your superintendent is driving home we are a Google doc Community unfortunately and when documents are
034made for the board they have to be removed from Google Docs they need to be put into word and then the track changes needs to be placed on them I think we have devised what it was Google doc which was a student a great student use system but Google doc does not provide that same level so we are continuing to educate and make sure that our staff is aware that track changes are the way we should be passing documents between which means we need to pull documents out of the Google environment and bring them into the word environment so yes ma'am I will continue to press on that thank you and then is there a way that we could get the link to today's meeting shared with Jack the YouTube because Dak meets Thursday night
035on this and I'd like that to be as prepared as humanly possible please and thank you and then looking at page five of the actual plan I have some concerns about the language in terms of parents ability to understand it and you guys read the line out loud now I'm going to have a hard time finding it okay so looking at the paragraph beginning sibling preference will remain going down to that line that you read in the event the incoming kindergarten and current siblings are enrolled in a school outside the new proximity plan map the parent may make the decision to waive transportation what does that mean I know what that means because I've sat through meeting after meeting after meeting but what is apparent new to the district or a parent who's being hit
036with this without having watched all of our meetings if we could just word that in a way that tells the parent they have to transport their own kid to that school then I think it would avoid confusion slide eight first bullet point if there are not available seats with any proximity Zone then the student will be transported to an adjacent proximity Zone what does that mean does that mean I get my choice of schools in an adjacent proximity Zone does that mean you place my child in whatever school has capacity in that adjacent zone I'm not clear reading that what that means for my child please and I don't need I don't need answers I'm just pointing out what might be confusion go ahead yeah Miss Patrica we'll we will clarify that language because we
037did put in there and adjacent and there are multiple adjacents so we'll clarify that language thank you and this is a question for the superintendent I guess it's just sort of urging you to examine whether student assignment has the resources specifically human capital to accomplish this I know that you have put more resources toward them in order to cut down on the weight for families but I think that we're looking at an event like we've never seen before so I just want you to you don't need to tell me I just I trust you I just want to make sure that has been considered not only are we working with additional resources but we're working with additional processes that allow for a DMV style appointment process there will there's there's always a hiccup in that
038having implemented that in a former life the hiccup will be when you like like all of us when we go in to get our DMV appointment or our appointment and we realize we can't get in there until November there is the possibility in the high point of Summer that people will see no window with which to get in but the software will prompt them to make the call and underneath and behind the scenes we can reserve appointments and other things an additional piece of this is Serena Ralph and her team along with our it Department have worked extremely hard to prevent everyone from having to come to student enrollment we are now a hundred thousand seat system you cannot have everybody come just to the central location to do what they should be able to
039do online get their school choice and then potentially follow up at the school site with the information specialist so they can complete the registration process all those things are currently underway and under plan as well as this also part of the airplane that we're building at the same time because we need to make sure that our parents have Avenues so they are not standing in line can I promise you there will be no lines this summer I think that would be inappropriate I think there will be some lines this summer but we have the Avenue in means with which to ensure that our parents get even better Stellar customer service than they've already received from Miss Ralph and her team thank you Mr chair I have three more do you want to move on and
040then come back to me does anyone else have any questions why don't we go to miss juvenile then we'll come back to you Miss patrico I just have a few so I was looking at the spreadsheet that we were that we were given in board member updates and my concern runs when I see that the Arizona schools have ranged from 62 percent to 86 percent that's definitely going to change Dynamics and culture of schools especially especially for like the K-8 schools and my concern is like are we looking at the future of what the culture will be when that shift changes when you have students that did not grow up within in the like at the K-8 you know it doesn't grow up in the K-8 but yet all of a sudden in middle school
041they are going to be at this K-8 school so because most likely they're coming from a different the zone is different for a middle school versus Elementary I mean because we don't have enough we don't have as many middle schools as we do elementary schools so my concern is have we thought about the changes and what's going to happen because I look at Edgewood and at 80 86 percent is out of zone right now so what does that mean for the future of the schools I'm really and I know it's not information that we have but but we know what we have now so what does that look like and you won't know until I guess people register and move and shift change but I am concerned over we have so many schools that are
042very successful and when that when the demographics change what does that mean for that's for those the school and that zone I mean I don't that's one of my questions you don't have to answer that I think that's information that may have to really be thought out second regarding once this is approved assuming that it's approved and I was thinking about this yesterday the maps the map that shows and the key where the schools reside and in each individual Zone I think we should have one like outside maybe in the lobby for people to see when they come in before going to enrollment I don't know if you needed one in enrollment but I was thinking that parents need to know oh my goodness theirs were this is where I live and that's the Zone
043I know you said that when they when they opened up on Focus they see the only the zone that they are going to be have the opportunity to select from but and that's great because that's narrowed it down but when someone might live on the line and they don't know exactly where they live and they think they're in this Zone and they really are in that zone like how does that coming I mean I think that's important to see the zones plus I think it's important to show the middle schools because people want to know where they're going to go like where they're heading and what their opportunity is going to be and knowing that beforehand would really help the mindset in the long term they come in and they see I mean I think
044this is something we need to be it needs to be out there in the Forefront for people to see and recognize and get comfortable with and I think that's really important because you know it's a change and it's a huge change and in order for everyone to buy in even if like a grandparent comes into a meeting and they see oh well my grandson lives in this Zone they're going to have this opportunity and then they go back and say Hey you know to their daughter or whatever this is where I see the schools the opportunity you know I just think that it's the communication piece that I think my opinion would be really important for the visual because I'm a visual person like and I've looked at all like okay I'm thinking okay so
045I'm looking at the school and the key so I just think it's something that others it would help would help with adjusting to that and that's all I have thank you Mr Chief minoli I think the idea of larger Maps is a fantastic idea and using the lobby and other places to get those larger Maps out I think we have to be slightly careful about adding middle schools because remember the middle schools while we could place them on this map their actual colored Zone will be slightly different right than the elementary and I don't want parents to assume anything right we've got we've got a big bite of the Apple we have to bite off on Elementary but I hear what you're saying as soon as we can get congruency with our middles the faster
046we can get back to our family so they can make the decision but keep in mind right we're we are moving K only really and generally most of our most of our kids will have the opportunity to stay in place to the high the high-end schools where you mentioned some percentages that are higher Dr Malloy has worked directly with those principles and he continues to work with them we are supporting them in a different way than somebody who might be 10 impacted we're already been online with them working with them getting them understand what potentially could happen but you are correct until we actually start moving our young people around through parental choice then we will not be 100 sure as to what the impacts will be other than we will have school buildings that
047are not over capacity and that we will have a transportation system that isn't a better that's in a better position and can I just add to that so that's exactly with the map so I so someone comes in and they say they see that they're in J but they like something in oh they know that only J is where they're going to have transportation and that's what I think really needs to be clear and they know that they would have to do their own transportation in an O so that's why I'm saying like I think and I know you didn't disagree but the getting the information out there in the map but for people to actually see it is really I mean I couldn't wait to get the map in my own hands and personally
048so I feel like that's what we need to do as well for the community thank you agreed yes ma'am okay Miss Jordan I thought I saw your hand up I was just listening to miss Gianelli but I guess my question is when do we start even though we're helping all the schools we're going through all this when do we really start letting people know letting parents know hey your child may not be at the school next year because you have this choice to make and I think that you know sooner is better and I and I have to and I know I keep bringing up my grandkids and everybody but the reason they know is because I keep speaking about it to everybody that I know because I know it affects multiple family members and
049but I'm sitting here so I can hear that but what about those who are not sitting here we need to absolutely I'm not going to doors for you whatever it takes we just hear you but without board approval to move forward with this we have nothing to tell our community until such time as the board approves hence the two work sessions the briefing today with hopefully a date certain moving forward on the first meeting in February and then it's it's it's a full-blown Bliss to make sure that our elementary schools and other people know how to access this data and make it work we need a board decision before I can start advertising what the changes are okay miss Patricia if you want to finish and then we need to move on thank you second
050sub bullet what does that mean siblings placed in same school after parents make proximity choice I don't know what that means so after the student the parent has made the choice for the student that's currently enrolled in the school they've done their school ranking then we want to go in for those students that have pre-registered for kindergarten we're going to link that sibling up just like we would have already pre-placed siblings in the schools we haven't been able to replace those students that have pre-registered for kindergarten okay and then slide 12 you talked about the wait list that wait list used to go through the first 10 days of school if I recall correctly are we doing away with that entirely so we actually changed that just a few years ago right so we stopped
051it the last of June we stopped at the last day of July because that gives our schools time to settle they give them a couple weeks before school starts to get their class schedules that also gives Transportation the opportunity to get their routes more finalized and make some decisions and get that information out on the website so I thought we changed that last year only because of the changeover in computer systems am I for getting am I remembering that inaccurately so last year was when I got a ton of constituents coming at me saying why is there no wait list why is there no wait list and I assured them it'll be back next year so last year what you're remembering is last year we stopped the wait list in June because we went to
052focus that's why you got a lot of phone calls okay all right very good and then finally to piggyback on chairperson's comments so a grandfathered student who chooses to go to the AutoZone school for fifth grade doesn't get transportation in fifth grade but does get Transportation six seven and eight is that an accurate understanding of our since you're talking about a K-8 school correct yeah so the K-8 school grandfather process could you just run through that hypothetical so I've got a rising fourth grader who's grandfathered into fifth grade but is not provided Transportation because the parent has waived that but when that student is in sixth seventh and 8th they will get transportation from us correct yes under the current plan yes okay approach yeah all right those are my comments some questions thank you
053thank you thank you Miss Jordan actually asked the question about Jason that I was going to ask so I appreciate that real quick unless there's any board members oppose this I guess Dr Malloy then if you can look at the language in regards to siblings on page five the aforementioned adjacent language and the map that Miss juvenile had talked about so thank you Dr Malloy thank you Miss Ralph I appreciate your hard work and getting through this project now we're going to move on to item number three single member districts and Dr Carlin will be presenting foreign as some of you may Dr Carlin sorry to interrupt just want to double check is your microphone on tomorrow okay now I see a red button thank you yep it was flickering so now we're ready let's
054dive into this conversation so we know that you know there were some conversations with board advisory committees particularly edac that came forward with a recommendation that the board consider eliminating at large seats and add two single member district seats that conversation happened in April and that was brought forward to the board and as we mentioned earlier there was General consensus to begin that discussion this year and 2023. now turn over to Mr pre Bruno is going to talk with you a little bit about the law in this regard as well as some history take a look back at what we've done thank you Dr Carlin and I also wanted just to mention that Mr Edie was going to be with us today he sends his regrets and apologies he's not able to attend this presentation
055today the statute that governs this is Florida statute 111.36 this is the statute that discusses School Board member of residence and boundaries the first section of the statute states that a board can have five single member residents area districts and two at large or you can have seven single member district areas section two of that statute talks about the boundaries and when they can be drawn so the board can consider redrawing its boundaries in odd numbered years and if the board decides to redraw its boundaries the board member that could be affected by that does not it does not impact them until the next election they're able to finish their term Section 3 of the statute kind of discusses a little bit further what the board will have to do to accomplish this one of
056the main things that the board would have to do is to do a resolution that discusses how they want to move forward with their boundaries and their whether or not they want to have the seven single member districts that will have to be recorded and then there will be a process to put it on the ballot agenda Etc when should the board consider this discussion every 10 years we have the census that's normally when we have the discussion about boundaries and this could be also the time for the board to have the discussion with regards to single member districts we I want to be very careful because there's two different things one is about the boundaries and one is about single member districts you have to make that decision first and then you can talk
057about the boundaries and then of course pursuant to the statute you can have this discussion in odd number of years foreign Mr Edie is much more versed with regards to the history but I'm going to do my best to provide a summary of some of the history that we've gone through with regards to single board member residence areas in 2001 2011 through 2011 we basically have followed the Lee County commission's map with regards to my boundaries in 2014 the board decided that they wanted to go to from five single member residence areas to seven and it will be five single member residents areas and two at large so they had seven seats and the breakdown that they had was five and then the two at large seats in 2021 because the census came out there
058was a lot of discussion with regards to the boundaries lots of presentations to the board and the board ultimately decided that they were going to follow the county map and that was properly notified to the state department as well as to the clerk of court in December of 2021. Dr Carling is going to talk a little bit about the map and then she will provide us with the information on the process and timeline all right thank you Mr pre Pruno so as you can see as Mr pre-brurner just mentioned this is what our current map looks like this was adopted by the board in December of 2021 so you can get a feel for the various districts and of course we have the two at-large members and so real 's yours right after this slide
059so you know obviously you can choose to remain as you are in your turn in your current form if the school board would like to provide direction to move forward with seven single-membered residence areas here is the process so as Mr pre Bruno said you know the board could pass a resolution we would need to do that in an odd number year so by the end of this year that decision would need to be made if you're going to look at the conversation relative to seven single member residence areas of course Mr pre Bruno would work in tandem with the Lee County Supervisor of Elections to draft the ballot referendum language that would then go to the voters for a vote on the referendum in if approved by the voters we would then go to
060work as staff to collect data look at analysis and make sure you know that all of the statutory requirements are met for some proposed Maps which would be brought forward to you and then finally the boards map would be adopted as adopted would be in place for the 2026 election cycle so that's essentially the process how this works and so at this point we're going to turn it over to Dr Bernier for any comments that he has and we are here to help anything we may do to further your conversation in this regard thank you I don't have any comments at this time this is really a board discussion I know that both Mr Puig Bruno and Dr Carlin are prepared to help you process through this and when we talk about the board developing
061a resolution that really would fall upon staff at your direction so I wanted to make sure that you are aware you don't have to build your own your own resolution here we're we're interested in hearing your discussion about this issue because this is a new board from the board that originally went through this process and depending on your direction we can begin to draft something and then come back to you with some additional workshops or briefings so that you can have deeper and richer discussion this is just our first opportunity to foray into this board's thinking regarding this issue thank you board member comments and questions Ms patrika I have a question before we enter into discussion if I may through the chair 2014 the five single member districts they were elected county-wide correct so
062the move to single member district voting occurred in 2016. okay I just needed to have that clear and I walked into this meeting 100 open-minded I'm really interested to hear what my colleagues have to say I have no opinion comments questions Mr persons now would this be just a voters in the single District voting or is it a county-wide this would be countywide the resolution with the ballot would be countywide okay follow up keep going Mr person I feel for my colleagues that have run county-wide it's a very difficult and very expensive campaign so I don't know if having all the candidates have to run county-wide is necessarily a great thing that's all thank you just for clarification Mr persons if the ballot initiative that would go to the voters to approve whether or not
063they want to move to the seven single member residence areas not having seven members of running county-wide the statute will only allow two at large members to run which is what we have now okay I then I misunderstood you so if we went to a seven single member district only the voters in their District could vote for them correct okay as it is now I mean I get to vote for three board members the two at large and the one in my district that gives me say in three votes right in this particular and I'm voting for someone every two years under this proposal I would be voting for only one person every four years correct okay Miss Jordan I would not be I believe that people do want to have you know their own
064representative so I would not argue to not have I would be an agree again to have seven because one what you said trying to go out and raise in you know I'm just going to put out a hundred thousand versus ten thousand or whatever that looks like and I do believe that even though we are voted in by our own districts we do represent the entire County we're not here to represent only one area of Lee County we are here to represent every child that comes to our school so we are representative of all of the county but I would be in favor of looking at moving to seven single Miss Morgan I'm not in favor of moving to seven single member districts one of the reasons I liked the hybrid plan was because it
065did provide for representation closer to home for families but I also believe that you run into a problem when you have districts competing for resources and having sat on a board that went from at large to single member that was the first time their bonds went they had to vote on bonds bonds went down there was a lack of coordination among the board I like the idea of having two people at large still I recognized that from a campaign point of view that's a problem but that's a community's problem that's not our problem so I do not at this time support it further comments at this moment Miss juvenile gosh I see both sides and I'm I'm kind of on the fence but one of the things I was thinking I know there's like Broward
066has like nine how do they have nine what what determines a larger board because we went from five to seven right right but back whenever that the timeline was I believe so what how do I it's got to be based on the size of their or a number of students I would think how do they have the nine Miss Morgan's saying no so do we know that answer I don't know that answer so I do not have that answer I would have to do some research on that Miss giovannelli it's not a matter of student population it's a matter of the voter referendum okay so that leads me to because I know we followed the County Commission but I still felt that we had a community that was under it underserved based on where their
067location the location that the whole boundary with the river I had a hard time because it was very across the river is very different from this side of the river and so I would be curious to see more of how we could could you add eight does it have to be or I'd have to be an odd amount a nod number okay so I would be curious about that information thank you Mr persons hearing things everything said so far I agree with Morgan I am not in favor of seven single member districts any other comments I was going to make a couple comments does anyone else have any comments or questions no for me and please correct me on this I believe I thought for 2014 that the how it is right now with the
068single and the hybrid model we have I thought there was a bit of a community compromise at the at the time and that was one that the community thought was going to work best at that time I know there were people on both sides and I thought that was kind of the best way one thing you know as I said we each have connections or Community within the district but one thing I do want to highlight and Miss Jordan brought this up is we're still accountable to the county as a whole so when we're looking at decisions we can't make decisions just based on our district we have to look at what is best for the district at hand the other thing for me one thing that Mr persons brought up that I that I
069think is a positive thing is right now we're able to vote for three out of the seven no matter where you live in this town you're able to vote for three out of the seven board members you go to a single member district you only have that one and if you're looking at people that are going to control the school district as a county as a whole I think that's very important so I mean I do have an open mind at the moment in regards to this but there's nothing at the moment that I should say that particularly moves me towards the direction of supporting going to a seven-member district moment unless somebody else has something else like to add at that moment I mean I'm always happy to to listen and see if there's
070other other perspectives on this I think at this point as I said I do not see a at least consensus up here of of moving forward further on this I mean that's something I'm sure we could always if there is movement further on we could readdress but I believe at this moment unless anyone disagrees with this let's move forward on this topic and I don't believe as I said that we would be moving forward with a single member district at least based on what I see from board comment thank you thank you very much my next stop is item number four long range planing Hector caparetta Dr Wagner Mr Wagner oh sorry we're moving on to item number four long range planning for Hector cafaretta for Mr Wagner and Mr Ross sorry about that while
071the team's taking their spot as you're well aware we've had a number of buildings disproportionately impacted Hector a caparetto junior Elementary School was one of those buildings they have since had to vacate their school ruling which lost its roof they are currently behind the Cape Coral Technical Center in a portable campus due to the generosity of this board in order to provide those families a single place in which to go to school in deference to Hector a cafaretta we wanted to ensure that we brought forth today a variety of options this is our first conversation about Hector a cafaretta and I'm looking forward to the staff not only being able to present the options but to hear the board discussion following as to where you potentially see paths or Avenues with trust to continue to
072explore so we can make some decisions about the future of a permanent facility potentially for this particular campus thank you board members superintendent Bernier as a superintendent Vernier mentioned today we are here to present the field essentially what are the available options as we move forward with Hector a caparetta Jr I am happy to report that the temporary campus is in place and was occupied in mid-December so we have reunited those students if you recall immediately following the hurricane those students were housed in two separate schools so it was critical to get that learner community of Learners back together and I will be speaking about that today in addition today we're going to cover the history of the hector cafaretta Junior site what was there what there is the history behind the namesake the current
073state where are we at today and then obviously a plethora of options really encouraging a dialogue today we are not bringing forward a single recommendation but rather objective information about what our options may be to encourage a dialogue receive your input so that we can take that input back and refine what ultimately will be brought forward as a recommendation the name ticket Hector Hector was awarded the Medal of Honor for his service during the Korean War that existing building is located in Cape Coral in the west Zone it was built approximately 17 years ago during a period of high growth and due to high growth and economic constraints at the time a modular building design was selected so when modular building design is said people often imagine Portables this was not Portables but rather a
074series of modular tubular steel units that were transported basically pre-constructed and assembled together on site the enrollment pre-storm was approximately 725 students and the latest enrollment data we have is 603 of those students have returned post storm as you're well aware and we've talked about both here at the board meetings and individually with all the board members Hector cafaretta's existing building took catastrophic damage we essentially had a complete failure of the roofing system due to high winds followed by approximately 10 to 12 inches of rain over the next 12 to 24 hours so unlike the damage we saw at schools where there was a storm surge essentially I think if you think of Lexington Middle School as an example took on a tremendous amount of water but that water was storm surge and gravity kept
075it at the ground so we were able to go into a school like that and remediate relatively quickly the water here started at the top of the building and worked its way through the entire structure so essentially any soft surface in this building including insulation ceilings drywall was saturated to the point that it had to be removed so the remediation effort at this school was quite extensive and we started that remediation effort immediately following the hurricane during that process we retained an architect to give us an assessment of really how bad is the damage and the architect came back and I'll quote from croak from his report here under any scenario the cost remediation will well exceed the 50 threshold for deemed threshold for Dean well he has a typo on his report but Dean
076to comply with the current code and standards for both FEMA and the Florida building code so essentially we understood well early in the stage that we had a decision to make about how we would go about remediating this building or if we would go about remediating this building to remind you just briefly what the 50 percent triggers is bringing the entire building to current building code so it's not just fixing the issues that are currently there it's addressing things like the fact that the exterior shell of this building doesn't meet the horizontal impact requirements for Florida building code so we would need to address that if we chose to remediate the building so when you see the cost today those costs include not only bringing it back to what it was but bringing it to
077current building code we're going to go over the options for the future and I mentioned earlier the portable campus well not an ideal situation was stood up in a very short time the students are back together and I know that Dr Kurtz is here today I spoke to him briefly he's making the best with what he has there and we're happy to report that the that community of Learners is back together I'm sure you've all reviewed these pictures in detail but we'll walk through them once again as you as you can see the post-storm pictures that fabric that looks like it's draped across the side of the building is actually the single ply roof membrane that is what protects your building from water it should not be on the side of the building but rather
078on top of the building so as soon as you pull that membrane back you've essentially opened up the building to the exterior elements and if we had if it had only been a wind event and we had not received a tremendous amount of rain we'd be having a different conversation today but the one-two punch of extremely high winds is compromise the roof with torrential downpour that saturated the building is what has led us to today next slide please again in the interior of that building it just saturated everything so it's not just that we had to go in and remove all the soft surfaces we had to remove everything that was in the way of those soft surfaces so that picture of the far right of the slide that's the cord war picture you can
079see that the silver metallic ducting there that's part of the mechanical system that system must be removed in order to reach the soft surface of the drywall and it has to be removed so upon removal we would have to reinstall it and a lot of that is what's driving the cost here for for remediation is not just what was damaged but the labor to get to what was damaged remove it put in new and put back all those systems in addition these systems are not made to be taken apart and put back together so of course as you do that you encounter additional problems things get broken in the removal process and all that's been factored into our cost estimates that we'll go over today so again I think I cannot over emphasize the fact
080I am not bringing forward in the School District staff is not bringing forward a recommendation today we are here to start a dialogue about what are the possibilities so you may look at some of these and your initial reaction may be like we're never doing that okay that's fine we're not telling you that you have to do this or you have to do that we're we're simply putting information in front of you to engage in a dialogue so we can hone in on what is the best solution for the district and the community at large so we'll run through four options today and they're going to basically run the gamut from taking what is there and bringing it back to pre-storm conditions and the upgrades that I previously spoke about to an option where we
081essentially do nothing but hold the property and reallocate the students throughout other seats in the west Zone and a couple options in between next slide so on option A this is this is straightforward action when it comes to building we could simply go in and restore what is there again that would mean bringing the building back to pre-storm conditions and making the upgrades to bring it to current building code I will note that this was a modular building with the life expectancy of approximately 25 years when it was built it was built 17 years ago so if we invest 20 million dollars in this building you still have a life expectancy of only about eight years we would have to replace not only all the things that were damaged the Roof System but the exterior
082shell so we're basically stripping this building back down to its structural component and putting it back together the assessment currently states that the appraised value of that building is 12 and a half million dollars as of the end of October so we're well beyond the 50 threshold here however the advantages of this particular option or it represents the shortest timeline so the buildings there we can get in and do the work relatively quickly we're not engaging tremendous Design Services because we're replacing in kind so there are some pros to this option as well as cons option b goes a step further it essentially says that due to the damage of this building we should raise what's there when I say raise that's what the Z dim we should demolish what is there and build a
083new elementary school this comes with its own challenges first of which is a cost of approximately 63 million dollars but more importantly we typically use Lee County typically uses prototype designs the Prototype design does not fit well on this site you can go to the next slide we can illustrate this typical new elementary schools have approximately 20 acre sites and that's due to a variety of factors but a great amount of land is needed for water retention and circulation around the side as well as the footprint of the building we've taken our site here where we have approximately 10 usable acres and we've overlaid in black there the footprint of our prototypical Elementary School staff has looked at this and determined that it's not feasible to use that prototype we would we would essentially have
084to go in and do a one-off design absorb those additional costs and time to be able to put an elementary school on this site option C is a little bit out of the box but it was brought to my attention shortly after I came to The District in early October that there is a piece of property the district has control of within three three and a half miles of this site and there is a need for middle school seats in this area that this may be an opportunity for us to build a new school that would inherit the namesake Hector a cafaretta Jr as well as Advance some of the priorities of your Capital plan so staff took a long hard look at this and the pros and cons of it and we've brought this
085forward for your consideration we have an existing prototypical design it means we have drawings on the shelf that saves us some time obviously they would have to be adapted to this particular site we are in control of the site where we're recommending for this option is to demolish the existing building hold on to the land it gives you options for future development in that area and there's at least a handful of different ideas about how that land could be used including the addition for Cape Coral Technical College and move Hector cafaretta to this new site that's approximately 3.3 miles away and increasing capacity in the west zone for six through eight as well as providing you a K in this area you can see this is the piece of property we've located the footprint of
086that prototype on this piece of property we have ample room to accommodate that on this particular site we've also included here what I'll call for for lack of a better term of proximity plan not related to what you've heard earlier today but essentially to illustrate not as the crow flies but what the actual drive would be to this site we estimate that at under 10 minutes and approximately 3.3 miles so option D represents the Other Extreme right so we had an option A one extreme of just simply simply restore the building this option says don't do anything with the building but knock it down because it can't stay it's a liability and redistribute the students that attended Hector a cafaretta to other schools within the West zone now if you look purely at the data
087we currently have capacity in the west Zone but I'll caution you that if we look at the demographics moving forward we also continue to see growth in the west zone so while this is an option and it also has pros and cons to be considered as we move forward we would inherit the cost of demolishing the demolishing the building because that needs to happen again we don't want to leave a skeleton of a building on a site that could potentially be a liability that would give us that piece of property for other uses it possibly in the future this would also allow students to go back to a physical building at the beginning of next school year so this would be the shortest amount of time in the temporary campus we've summarized that kind of
088much the way you've seen a summary like this before in some of our other presentations again this is just objective data of what anticipated costs may be you will see in this summary a line item for fixtures furniture and equipment to be determined can totally contingent upon what can be reused what is the actual final decision you also see the fish capacity because these options impact the overall fish capacity of the district we wanted to make sure that was noted here some of the options remain keep it the same some of the options increases some of the options decrease it so with that I think we're we'll move on to the superintendent's comments and board discussion again our goal here today is obviously to be here as a resource to answer any questions you may
089have but really to create a dialogue amongst yourselves and with staff to provide further Direction so we may refine one of these options two of these options maybe all these options or perhaps today we get direction to explore some new options so with that I'll pass it over to the superintendent and take any questions I see him smiling maybe I offered too much to Wagner got into his last sentence I thought we had the perfect segue to say Mr chair I have nothing to say I think we have a number of options here I don't know that we need any newer options but if if that is the board's desire we are interested in just seeing what what else we might not have thought of you have everything from rebuilding the building in its current
090location with its current frame and structure all the way to doing nothing and putting those children into seats as they currently exist in one-on-ones with all of you I'd be very interested to see and hear your discussion today related to the future of our school building and what some of the other options and which options are resonating with you as we think about the future of the school building and these young people thank you Mr superintendent before I proceed to board comment and questions want to ask the superintendent real quick what are you looking out of for the board today are you looking to see if there's other options are you looking us to narrow anything or my preference sir if you're going to give me that opportunity I will take it my idea would
091be to narrow some of these options potentially eliminating some of them so that we could look towards not only what we could do for Hector but what we could do for the future and how we could utilize this opportunity to not only make Hector cafaretta whole but also to potentially provide what we know are is a growing population not as fast as the East but growing and your Capital plan does outline the need for some Middle School seats here in the very near future so we got very creative with option C thank you Mr superintendent I just wanted to provide the board a lens for that when we talk about this discussion so what board member comment and questions Miss Langford Fleming please proceed just a quick question the going to option C with the
092new site you said it was 3.5 miles from the original site did I hear that right three and a half miles and then does that with our new with our possible new proximity plan possible where does that which zone does that fall in will do you have that answer according to Dr Malloy would stay in the same proximity Zone okay thank you Mr persons what is the timeline for both B and C I mean we have Portables that we've okayed for two years basically so are we able to get that done by then so I'll give you timelines on all of them just because it's in my head that way okay so option A the timeline is approximately 12 months 310 days of Construction Plus time to move into the new building option C is
093455 days of Construction Plus time to move into the building so you're looking at approximately 24 months by the time it's all said and done option b falls about the same time as option C and for the following reasons option C we have a plan on the Shelf ready to go yeah so we're only talking about the redesign that is required to adjust that to the particular site option b we there's nothing on paper so there's a design timeline so the time difference between option b and c they're essentially the same time despite the fact one building's larger one building smaller but the extenuated circumstances give you approximately a 24 30 month timeline depending on how quickly decisions are made and what I mean by that is obviously different times of the year we're able
094to accomplish different types of construction so if we're going into rating season that means something different for excavation than if we start excavation now things of that nature so 24 to 30 months foreign thank you I personally lean toward if we're going to need a k i mean a middle school I think it would be more prudent to go ahead now while we have the plans rather than have to come up with a whole another set of plans at another site to just go ahead if we're going to do B or C I'm leaning toward C it's Jordan or I have to agree too I believe that if we know that the future holds that we do need to add that middle school and I know that the growth is crazy out there and it's
095going to get busier for sure because there's land out there to build but also because I know it drives me crazy when I see one street being built and then one lane and then we know next year there's more construction because they have to add that other lane which we should have added the first time so to me I think that if we have the ability to do the if we have the new site we own that property is that correct that's our property we own that so there's no cost there and if we could do that and where does the like the insurance and from the other does that come into play with the funds for this yeah so we have a certain certain available funds under insurance we have certain eligible funds under
096FEMA reimbursement those funds are not it does not dictate those funds do not dictate that we have to rebuild at that location those funds dictate or essentially determined by what was lost for using the funds in a different location to meet the needs of the district that is allowable under FEMA regulation okay thank you yeah because I'm just looking at where those funds come from and if we do have that and of course we would never leave that building standing as as such I just can't see us rebuilding that building because just walking in up to there before even walking into that just yeah I just couldn't even see that taking place so I would be in favor of option C if that is something that's doable to the to the district and financially you
097know sound so just to add a little bit of context obviously if option C was the selection it would be funded for multiple sources right there there's certain money that's available on the capital plan there's certain insurance money there's certain FEMA reimbursable money so FEMA is not going to reimburse you for the cost of a K-8 if you didn't lose a K-8 so this kind of combines in many ways it's looking at the what happened and what the options are moving forward and combining some of our resources to put the district in the best long-term solution from a capacity standpoint yeah thank you and I understood that I just wanted to make sure that those funds we did have some of those funds that would carry over to that so thank you so much Jeff
098Mr Wagner Miss Morgan I think was next oh all right okay so the difference between B and C Is 40 million so for for 40 million you get a six eight basically schools housing how many students I'll defer to Mr Ross he has the exact numbers so he doesn't have so Hector cafaretta like we said before storm was 725 students I believe the fish capacity was slightly more than that so we would replace the actual fish capacity where what we use and I want to say that a middle school a K-8 is 1800 seats I'm looking at it at your longtime staff that answer that's approximately correct yes 18. so approximately 1800 seats so yes cost per Middle School seat would be lower than if we built a middle school outright cost per seat as
099we're absorbing some of those site development costs and other things by combining it I also understand that there's a preference in in this district for k-8s in certain circumstances talk about FEMA dollars sometimes I think not just not just on this topic but on Fort Myers Beach Elementary as well we talk about being good stewards of taxpayer dollars FEMA dollars are taxpayer dollars so I think sometimes that gets lost when people think oh FEMA's just going to pay for it well that's everybody Nationwide their taxpayer dollars so we have a responsibility towards that as well that being said my first question is what gives us which of these options gives us the best chance of reimbursement by FEMA that is a loaded question as FEMA is really indifferent to your proposed option they are more
100concerned about how you document it so we have to have a strong documentation and narrative around why we chose this particular option so I couldn't say that you have a 30 chance of FEMA reimbursement if you do this a 50 chance of female reimbursement if you do that temporary facilities are eligible under FEMA and we worked with our consultant before we ever put up the portable camps to ensure that was an appropriate use now are we going to have to justify why we needed a temporary campus longer in a K-8 situation quite possibly but if we were to rebuild that school we would need the temporary canvas for approximately the same amount of time so at some point may we have to answer the question why didn't you just go in and renovate the school
101at 20 million dollars well your team has own regulations say after you exceed 51 percent you should reconstruction should be a consideration so it all comes down to how well we document it we're working closely with our partners at Imperium they've been on the ground since day one to make sure that as we move through these options we are being good stewards of of the taxpayers dollar and that we are putting ourselves in the best situation for FEMA reimbursement so I know I know that's not a direct answer I apologize for that but that's the best answer I have for you for you now is I don't know that any of the options give you a better chance at reimbursement than others I think you're going to hit a maximum threshold of reimbursement based on
102what was lost and that's really going to be the selling we bump up to in any case and in my mind and this is a personal opinion not FEMA I'm not I don't I'm not speaking on behalf of FEMA what was lost was a elementary school with x amount of capacity what does it cost to rebuild an elementary school with x amount of capacity because then it did receive more than 50 damage which essentially what is the cost for option b that's what our maximum eligible reimbursement should be and we're going to make the strongest argument that option a while on the board was really if if this board decides that's what you want to do absolutely we'll go on execute option A but we're not shoehorned into option A because we have exceeded 50
103of the damage okay and then eventually the same weakness that we had before right like we're just rebuilding something that the roof so in option A we have carried costs to make improvements to the exterior shell because it doesn't doesn't currently meet the projectile requirements of the Florida building code and we have carried costs to improve the roofing system which was the catastrophic failure in this particular case and that's important for a number of reasons if you just go and build back what failed at the same level that it felt if it ever fails again you're going to be asking answering questions of why didn't you take these precautions so we have carried additional dollars to make those improvements if option A was selected see the carrying costs of the Portables on there isn't that
104part of like one of these 12-month option one of these is a 24-month option in terms of the Portables but I don't see that cost in there yeah so we've discussed those costs internally however they varied and we wanted to be careful about not influencing your decision based on sunk costs so there's already a sunk cost associated with that portable campus in all the cases if we use the portable campus for less time obviously we avoid some lease payments on the continued lease assets all right if the portable campus has to be in place longer obviously there's going to be additional cost the cost per month our lease cost per month is approximately 500 000. all right and then what does the Ka really just the Middle School part because that was part of our
105Capital Plan before our approved Capital plan where does that Middle School fit in our Capital plan like what year were we planning to build a middle school in the cape do you know we will have to do additional research how to do additional resources I understand it was later Mr Wagner I met today we are finally getting our hands on a lot of the documents that we've been looking for regarding Capital plan and we will make sure we provide an update to all of you with an exact date and where this school building would have to move from in this in what the current what the board has currently approved and where it would need to move to We believe that an entire refresh of the capital plan is going to be necessary here as
106we look out not only the five years that we already have but we also have to look out for the additional buildings that we may have to build moving forward so we plan to bring that back to you but yes we can answer that question we just don't have that data this morning right and then finally Mr chair my conclusions are I think option C is genius I really do I have been hesitant to speak about it publicly because it was presented to me in a one-on-one and I know that staff had not yet put together sort of the information on it so that I could support it publicly but but this to me is the big difference between Caprara and Fort Myers Beach Elementary I spent 20 million we spent 20 million on a
107portable campus with the chance that maybe we're not going to get reimbursed for the permanent building but that permanent building is already in our Capital plan so to me we already have the money to rebuild this school whereas with Fort Myers Beach Elementary we don't already have that money it's it's really a it's really a choice with with Fort Myers Beach whereas here we can accomplish everything even if FEMA doesn't reimburse us for this second step so I think it's genius absolutely genius and I fully support option C at this point wanting to see what what will have to be sacrificed in the capital plan in order to make this happen but I do think that if we move forward with C it would have to be prioritized so as to occur for the building
108to start to occur right away those are my comments thank you Ms juvenile okay I just refreshed my memory the present the original site is 20 acres the site that the portable site that they're on now is how many acres do we know I know I think you've told us but the current site the cafarota sits on is approximately 10 usable Acres it is larger but there's an enormous retention pond off to the left-hand side that you don't see on this and it's really not usable the portable site is currently on a very small parcel of land immediately behind Cape Coral Tech I'm going to tell you it's probably about three acres I don't have that exact that exact Dimension with me today but it is on a very small parcel of land that was
109formerly used as a portable campus was slated in your Capital plan for an addition to Cape Coral Technical College and obviously once we are done once we re-house Cafe in whichever manner we do that temporary campus would go away there's no intent to keep it as a permanent facility in any way shape or form it wasn't built to be a permanent facility and we essentially shoehorned it in on the on the available land so I can certainly get back to you with how many acres it sits on but it's a very small size that's irrelevant I just was curious so the but the new site then how many acres is the actual if we did the case eight on the new site how large is that what to say I believe it's 40 acres but
110I can also get back to you on that okay awesome we're all our planning pool the actual accessories map okay so that was where I was going to lead to K-8 needs a gem versus Elementary School we don't do gems so that's okay so that's that's great a kid includes the entire Middle School curriculum yeah and the facilities associated with that medical curriculum so that's so that's my question so presently the small temporary site that they're on now they could stay there while we built the K-8 at the other property right or they with the new proximity plan you may lose people people and parents may not want to stay in that small portable so you might lose them to the surrounding opportunities other schools that they have opportunity to go to but they may
111come back for their the brand new K-8 so I mean so there's you could do this the size could even be smaller because parents obviously may not want to wait you know 24 months so they might go to another you know real Elementary School unfortunately but I mean that's something that the numbers could dwindle based on the approximity plan and opportunity to change schools yeah it's certainly possible the K-5 enrollment May shrink over the in the interim with the K-8 enrollment most definitely will be more than the K-5 enrollment ever was right if that makes sense no no I would completely agree I think that it would increase at that point because I mean everyone I'm people love that environment that K-8 it's a very family oriented focus and they stay in that school it's
112people love it so okay thank you very much I support the K-8 thank you Mr persons the plans are from the Estero K-8 school what about the materials that were purchased for them where they should be able to be used so it is it is my understanding that there was a material purchase of still that still sits in the yard at Canal and yes it would be re-utilized should we move forward with option C home that's good thank you Miss Langford Fleming I agree it just it sounds you mentioned it before for 40 million dollar difference we've got a brand new school that's up to code on a piece of property that's large enough to withstand the amount of growth that's projected to be in that part of our County and we hold on to
113the other land so it's basically two pieces of land and a brand new school am I following you're correct and obviously we plan to stay if we plan to keep that location that they are our property already I can see actually in all the options we have not recommended nor would I recommend that you dispose of the piece of land that Hector Caffrey is on again it's adjacent to Cape Coral Technical College there's some opportunities there there's also other opportunities in the future it's a large enough piece of land that I would never advise the school district dispose of it you never know what you needs may be in the future so with that being said first of all I don't know that cafferata would lose many because I know Mr Kurtz personally and his
114staff loves him and he runs a great he runs a great ship so I'm pretty sure he's not going to lose too many but it is a good point would there be an opportunity I know I had worked in a school district where I actually worked on the site where a sixth through eighth grade new school had been built and while the students were in Portables they built that in phases so it would be phase one they moved sixth grade in for the year then they moved phase two and there is would be seventh grade the seventh grade Wing was then built then they moved in however many months however that looks the reason I'm asking is because if you could build it in phases could that then start to chip away at the cost
115that we're spending on Portals we could certainly explore a phased project I personally having built a number of schools that way I recommend against it brings its own challenges and construction costs escalate because of the challenges that it brings however we can certainly explore that I am not familiar enough personally with these plans to tell you yes there's a good line of demarcation where that can occur but I'll go back and put our heads together with staff and we'll explore that concept and as we bring this forward again we can discuss that in Greater detail so we'll we'll look at what a phased implementation may look like thank you I'm gonna make my comments if everyone's all right with that right now this hurricane obviously was devastating and I mean obviously what happened to our
116schools including Hector caparetta but I think this is one of those times we look at what happened with Punta Gorda and we take what happened that was negative and we build it back you know it increased even better than what it was before I think we have a real big opportunity here so this would be located in the district I'm located district one and looking through stuff I'm a fan of k-ray schools I personally went to one to myself many years ago so and I know how big of a community atmosphere that creates you know just from K-8 it becomes a family at that point so I'm on board with K3 ace at that point another thing I can tell you as well is that area in Northwest Cape Coral if I recall has the
117most number of single family permits within Cape Coral that has been flying record pace so population wise that's that I don't have a concern with so we're we're that is our last part of Cape Coral that is getting built up in the Burnt Store Corridor over there in fact is going to be one of our new major roads off of Pine Island in regards to being a commercial and residential base so cost real quick what would the cost of approximately a new Middle School would cost right now I'm guessing it currently I think about 120 million dollars is the last cost that Scott Rickenbacker gave me but we can certainly get you a cost estimate from our latest Middle School okay thank you see I see this as a win-win and much of what my
118board members have said we can you know we can make Hector better and then even increase what we have and looking at what member Patrica said obviously being a steward of tax dollar is very important to me and I think we could look at this as a long term investment that will actually save this community a lot of money down the road because there is that need up in Northwest cape for that for additional schools and like I said population wise it's it's definitely increasing and there's a big single family preference over there right now the other thing is obviously also in tandem then we could look at the land and we've talked about this was you know do something with the expansion of Cape Coral technical college so I think this is a win-win
119I'm I'm fully on board with option C with this one of the other things for me as well looking at this actually question what was the approximate build time was it 24 approximately 24 to 30 months okay on that would be the other thing unlike member Patrica I think Dr bernier's has seen this but I've actually done a little informal talks around to people within the community whether it's Community leaders over in Cape Coral whether it's parents heck I've even talked to a couple on the soccer field and I'll tell you that this is something that I believe the community would readily accept there especially seeing it's a K-8 so at least just the feedback I've done from over the past probably a few weeks there's a positive outcome on this now looking towards what
120we are as the board members right now I kind of want to go forward and see where we're at if I'm reading us right option A I don't believe seems to be on the table for anyone does anyone disagree with that option b seems like it may still be a possibility for some of our members I don't know about that I can at least say we all see that option C is on the table and I believe option D I don't believe anyone sees on the table so I would look at it if the board members agree with this let's put our energies and focus into option C and then if there's any concern we could always roll back to option b but I feel like it seems like option C is the preference of
121all the board members up here if we agree with this okay go ahead I would be really interested in the answer to Mrs Langford Fleming's question about decreasing the carrying cost for those Portables I thought that was a really good question I understand what you're saying but sometimes dollars and cents can make a difference so see with that caveat okay so what I'm going to ask is then the board is asking you Mr Wagner Mr Ross then if you could look further into option C and look down that path and then answer the questions of the state's build out that member Langford Fleming had please anything else no Mr superintendent Mr chair I'll be happy to direct staff to take care of that hearing your discussion see appears to be one of the better options
122we've brought forward in a little while I appreciate the genius applies to the two gentlemen seated there as well as other members of the construction staff who in the midst of the disproportionate impact of this hurricane got creative and started thinking outside of the box of what the future for Hector cafaretta could look like I think this does provide us an option moving forward not only for the young people of Hector cafaretta as they currently sit but also gives us the opportunity to deal with some of the growth that we expect in this cape area so appreciate that we will continue to revise this particular plan we'll move forward we'll get some of your questions answered on proximity potential phased in approaches to the students occupying the building and appreciate your direction and staff will
123go to work thank you Mr superintendent I see this as better in our district well also saving the taxpayers money for the future and long scheme of things thank you Mr Ross and Mr Wagner just add a little bit of context on to the superintendent's comments I want to be very clear that this idea originated with your staff that staff Scott Rickenbacker and his staff are really who brought this to the Forefront just so I know we get the praise a lot sitting here at the diocese these ideas are coming from throughout the district they pulled together brought this to my attention and said do you think there may be an appetite for this I said well let's let's put everything on the table so you should be very proud of the staff of Lee
124County School District for thinking holistically about how they approach it you're in very good hands I just wanted to make sure that I had that opportunity to say that thank you I want to ask real quick before we move on to item five we want to take a quick five minute re-test for everyone please okay let's take a five minute recess and re-adjourn at 251 please oh my God sorry about that mic issues again the time is 2 51 and we're going to reconvene our January 24th briefing at this moment we're going to move on to in the agenda number five policy review first reading we could proceed with that thank you Mr chair German we have several policies to come before the board some of them were pre-briefed prior to by the prior board
125so at this time I'm just gonna go down the list and see if there are any comments or questions the first policy is 2.181 instructional materials program any members have any questions on 2.181 at this moment or comments foreign so I don't understand beginning at line I think 327. I understand that this is probably coming directly from statute but I just don't understand what this means . and that is correct a board member MS patrika it is specifically in the statute and I'm trying to pull up which one that is now I believe it's one zero zero eight point two five which sets out the expectations of the vendors and the manufacturers of the textbooks and so this policy ultimately was added to take our current policies which kind of refer to the statutes and
126instead spell out the statute specifically within the policy so that way we're meeting the statutory guidelines without just referring to the statutes okay that's fine but but substantively what does this paragraph mean please if if I'm a publisher what is the impact on me of this paragraph I just I'm sorry I just don't understand it I mean I get why we put statute into policies I just don't get what this specific paragraph means give me one moment as I finish reviewing foreign thank you my understanding and reading of this section of the statute I think is considered to be a in a way a non-refundable deposit should the manufacturer fail to meet the expectations after we've gone into reasonable negotiations with the contractor for the loss of time for our staff and others if they
127fail to execute the contract and the bond within 30 days of the receipt of the contract in regards to our procurement policies regarding textbook and instructional materials would be my understanding of this section of the statute so when we when a man when a publisher bids on textbooks from now on they have to give us a deposit that's not something we've done in the past unfortunately I'm unable to say whether or not that is something that we have done in the past and as my reading of the statue when the reason that it was placed in this policy that is being brought to the board today is because this is what the statute is allowing us to put forward so my understanding if we've not done in the past this would be a allow allowable
128use under the statute for us to use going forward and I will just add that academic Services has reviewed this and this is something that they've approved unfortunately Miss Scott was not able to be here she's the one who's the lead for academic services but this is something that they desire okay I guess I need a little bit more background on this specific section because I'm not I'm not really clear I mean if it's permitted by Statute that's one thing if it's required by Statute that's another thing I'm not hearing whether it's permitted or required and I just I mean is this common practice for other bids that we receive and I don't you know you can take time to research that and get back to me it just this struck me as odd and
129difficult to understand so instructional materials go through a different process than our regular procurement process right but I will go ahead and we will go back with the team and we will provide you with the answer Miss patrico I appreciate that and then my second comment and this will apply to all of the policies today how would you like me to handle scribner's errors throughout the policies I know it's not what you say it's how you say it I say it with the utmost respect and concern for those who are hearing my comments but these are riddled with errors and I'm wondering how to go about communicating that not only with you but with my colleagues as well so we I sent an email I think it was probably about a week or a week
130and a half ago requesting any comments from board members questions from board members and if any board member found any scrivener's errors which means typographical errors to please provide that prior to this meeting so that I can go back to staff we can review those questions we read those comments and so when we did come before the board we had a very clean copy that incorporated all of the comments from the board and we're going to try to do that from now on for all of our policies so that prior to coming to the board we have the cleanest copy as possible for you to consider so if the board members would when you get that email that says please provide me comments questions concerns by such and such date if you could do that
131then I can go back to both the legal team as well as whatever division is responsible for the policy and have the discussion with them so then it is an expectation for the board to be sort of reading these with an eye toward sort of grammar and type graphical errors instead of it coming to the board as a clean copy no these templates are templates that have been copy written by Neola these are neolas we're not starting from scratch and writing policies I understand Neola is providing these with the templates staff meets with staff meets together to review them I think academic Services probably has six or seven people that sit down and actually go through line by line word for word the policies they compare it to our current policies as well and then
132they will also meet with Neola and ask questions before this even even comes to the board for consideration and then on top of that I have sent emails to the board requesting you to please review it as well and provide any questions or feedbacks or comments that you may have so that I can go back to staff and have that discussion with them so that when we come to the actual briefing of the policy or Workshop it's the cleanest version that we can possibly provide you member Patrica that I'm done for now thank you I was gonna actually say I would say in regards to scrivener's errors right now perhaps send those offline so we can deal with the substantive Parts at the moment just based on time so that would okay thank you Miss
133Morgan I have two questions and then a comment on this policy the first question is well it's line 43. this whole business of reviewers and employing reviewers was new to me I don't know I must be in la la land but the board May employ or contract with one or more instructional materials reviewers we don't do that so by doing this and we don't refer at all as I recall because this is a long policy to the textbook selection committee so I wasn't quite clear all right so that's my question what's that all about and then my second question is line 226 I don't understand it how it's written foreign it says each book newly made available to students through a school library media center or included in our commended or assigned a recommended not
134our commended that thank you oh I looked at that and I said what do they say okay so my general comment is that can we separate instruction materials are two things they're textbooks and there are media center and reading lists now you go through this is a lengthy policy and I think if you're a parent and you're trying to understand what's happening with respect to the media center and reading list it would be really helpful if we separated this into two policies one called textbook adoption and one called media reading list or supplementary instruction because sections or Pages five six seven eight and eleven all refer to that they have paragraphs referring to reading lists and Library materials but they're inserted in the textbook things so I just from a public point of view and
135in terms of putting something on the website with respect to materials it would make sense to divide this policy into two so that's that's my recommendation question for attorney Dupree Bruno looking at this policy and referring to what Ms Morgan just talked about as Neola normally would be keeping this policy together as a single policy so Neola does have an instructional materials adoption policy and you will find in and this is something we're going to have a one-on-one that's going to really go into the background of how all of this process works we're going to have that in our next one-on-one but you will find in the Neola policies that there are repetitions you will find the same policy in three different sections of the Neola book so they do repeat they do restate and
136it is part of different policies the same topic so I understand what Mrs Morgan is saying in terms of seeing if we can kind of condense this a little bit because it is very long this is the policy that they have and we will the team will go back and we'll take a look at that as well but there is a second policy and the other thing I want to make sure that the board is very aware of as well these policies that we're utilizing from Neola are guaranteed so if something happens where some somebody challenges one of these policies Neola is indemnifying and will represent us as part of our contract with them so we are very very careful sometimes with changing substantive parts of the Neola policy because if we change it too
137much it is a possibility that they won't warrant the policy I don't know about this one in particular 2.181 because this the length did not come up before so I will discuss that with them but that's just something for the board to keep in the back of their mind if I may follow up go ahead Miss Morgan thank you I understand what you're saying so I guess it would be helpful to someone like me if this appears if the textbook I mean if the reading media center and reading list piece occurs in other policies or as a standalone policy it would be nice to know that or have that as a reference when we discuss these policies because I hear exactly what you're saying but I have no confidence that from a public point of
138view there is these documents are really accessible so that's that is my final comment and Mr chair if I if I may so what we're going to do this is going to be one of the last times that you're going to have policies come to the board through us these were what we call fire policies we didn't want to fall behind with the statute changes from this year and these were kind of out there they had already been pre-briefed so we're bringing them to the board but what we're going to do coming forward is you're going to get the full Neola book of all the policies for example operations you'll get all of the operations policy and you will be able to see that so that's what we will be doing coming forward so you
139can see everything with regards to the instructional materials adoption that is policy 2.18 that was brief two weeks ago and that was actually on the agenda for tonight but we have pulled that because we're going to review that again so I and I understand that it's a lot of policy so that's why when we have our one-on-one next time I'm going to go through all of this so that it's fully comprehensible so you are prepared for when we actually start going through books versus individual policies thank you okay looking at this we have paragraph 327 line 226 and the prior statements from Miss Morgan in regards us outside of that is there anything else anyone has Mr pre-bruna I think what I would like to recommend given Miss Morgan's comment is that Neola will be
140here on Thursday I'm not going to ask the board to move this forward I like to present this to Neola with the question as to whether or not it could be broken in half or at least Limited in some way because it is lengthy and then when we are going to the 2000s we'll bring this back to the board for consideration Ford is everyone good with that holding off on that until we talk to Neola proceed Mr Blue Bruno thank you the next policy is 2.0622 student and parent compliance I don't know if anyone has any comments or questions this was pre-briefed to the board as well we did add a additional line you will see that it is highlighted this is very almost not quite but almost word for word from the statute any
141questions concerns comments board members Miss Jordan thank you I believe and I know Mr free Bruno I spoke to you about this and I know we spoke about this before what happens when that parent does not feel comfortable speaking with the principal where do they go what is their Avenue and I know this has been brought up and I think it isn't another policy as well so the at the last time on the board reviewed this there was an ass that at least give the principal an opportunity and if the principal does not address it then it can go through the official Complaint process anything else from board members in this policy do we want to move forward on this policy to a second reading then okay there appears to be an agreement to move
142forward on this policy thank you for two when we brought this to the board again this is very pretty much almost brought forward from the statute there weren't a lot of comments on this one so I don't know where the board is now on this okay questions or comments on policy 4.142 I think Mrs Morgan Sorry Miss Morgan it's okay the only question I have is parent notification this is line 58 through 62. parent notification of withdrawal to eligible private school parents who elect to attend an eligible private school through the Hope Scholarship program must inform the district at the time of withdrawal what happens if they don't I know we I remember we had this conversation as well when this actually came up and I it's quite difficult we can just request that the
143parent do that expect that they do that but how do we enforce it that's very difficult I know that if I remember correctly when we had this discussion I think there was discussion in terms of items that the student may still have that needs to be returned that may be one way for us to do that and I don't know Dr Fernando do you have any thoughts about the withdrawal I know that it becomes increasingly difficult once a student leaves how we how we go about pulling them back or or securing information or materials from them it's one of those things that the parent has the right to pull the student and I I don't have an easy answer to the question didn't this come up before as a financial issue where students with we
144were with the funding for the students was withheld or pulled Claude back at a later date because we didn't know about the the withdrawal and so I am wondering if there needs to be if a student goes to a private school I mean yeah they don't have to tell us but we don't have to we don't have to transfer the records well I think statutorily we have to transfer the records the issue is if I remember correctly and your correctness is Morgan because I do remember some discussion about that in terms of funding I'll have to refresh my recollection I remember what we discussed but I do remember a conversation and I do believe that the doe is monitoring and is gathering all of the information on the Hope scholarships so they're also monitoring to
145make sure there's no double dipping if I remember correctly that's where the discussion was leading to but I'll double check and if I may I think this is a great conversation for us to discuss with both Kelly Letcher and yeah Amy dustmore there has been some discussion about these types of scholarships at the doe level regarding how they're funded where the funding comes and how the money moves through the District Two certain scholarship programs not necessarily always in the Hope case I hope Hope Scholarship program but I think we need to have a more direct answer for our board so I'd ask the attorneys could please see that the guy said they could just write this down and then I will follow up with Miss Letcher and Amy Dr Des Moore trying to get a
146better feel for how we might be able to look at I appreciate what you say about callback but I don't remember seeing anything in the legislation that develops Hope Scholarship that we have that ability to claw back so let me take calls back from us yes all right let me see what I can let me see what I can find out thank you I don't have no answer Mr persons it would seem that there would be notice of withdrawal when you got a request for the records and I is that not coordinated or I don't see the I would think that would be a timely happening in most cases sir it is there's not always that case though in some cases students do withdraw and in a sense when they would draw if a student
147goes through a normal withdrawal process they come into the school when they announce they're leaving parents have conversations with information Specialists and registrars and they make the decision there's a withdrawal form there's a formal collection of the property that belongs to the school district and then records are usually sent for we never put records in the hands of parents to carry the next school building there's a way to transfer those records appropriately and securely there are times where students and parents don't withdraw I'll use the word leave they leave and that becomes incumbent upon us as a school district to try to figure out what happened to that student and without good contact information or other things sometimes we don't know where a student has gotten off to thank you for that okay outside of
148the follow-up that Miss Morgan was requesting are we ready to as a board move forward on policy 4.142 to a second reading we shall move forward thank you attorney Bruno thank you and next I'm going to go since Miss supke is here she works with our operations and this is a new policy 9.12 telecommunications facilities on district-owned sites are there any questions on that policy board members Ms Morgan what is look this is the very beginning very first paragraph the board shall consider proposals for telecommunications Foster competition is it an expectation of the state that we are responsible for fostering competition amongst telecommunications carriers it's not an expectation that we Foster I think a lot of the things that we do from and this is not purchasing this is different but a lot of the
149things we do is to get the best price that we can competitive solicitations bids Etc so this is to encourage us to have the discussions not to I understand what you're saying Mrs Morgan are we going to go out there and have a competition between these telecommunications no but to try to guess the best deal if you will that we can thank you any other questions from the board okay all right let me move forward with this okay our whizzle board ready to move forward on policy 9.12 to an additional reading okay and at this time I'm going to ask Mr dotig to come and join us for the HR policies the first will be 5.3111 mandatory reporting of misconduct and the second will be 5.14 official Personnel files this was also pre-briefed to the
150board any questions on 5.3111 board member commenter questions Ms Morgan I'm I am sorry but did I didn't bring this up when it first came through but is there any reason we can't call this mandatory reporting of employee misconduct instead of just misconduct because the policy refers to employees and people looking at policies I think it would make it easier thank you I think that's a great suggestion Miss Morgan any other comments concerns changes we want on this policy if not we have a ready to move forward on policy 5.311 to another reading yes we still want to move forward yes thank you free Bruno and then the last policy is 5.14 personnel file foreign okay do we have any questions comments concerns on policy 5.14 board members Miss Morgan first paragraph no sorry it's
151not the first paragraph second paragraph line 13 to 15 materials relating to work performance discipline suspension or dismissal will be reduced to writing and signed by a person competent to know the facts or make make the Judgment I'm sorry if I missed this before does that simply mean that every everything in the file is reduced to a single document for the individual design yeah I'm gonna let Mr doad again to that question which one it's lines 13 14 and 15. what that and that's right from the statue what that means is that if there's information that you're talking to an employee or counseling an employee about that is disciplinary in nature that needs to be reduced to writing you can't just keep something that's unofficial so to speak so but it says materials it doesn't
152say conversations but that's but that's what yeah that's what's meant essentially yes thank you and one other question section or lines 54 55 any material that is derogatory to an employee shall not be open to inspection for an additional 10 days after the employee has been notified either okay inspection by whom that would be a public record to request okay thank you those are my questions okay board members are we ready to move forward to a second reading on policy 5.14 . seeing yes we're ready to move forward on that policy thank you and board members just for clarification policy 9.12 will be going to Second reading it will actually go to a first reading because this was a pre-brief so we'll have to be advertised to start the rulemaking process on that policy thank
153you Miss Dupri Bruno thank you very much thank you next up is public comment attorney Dupree Bruno please address public comment thank you Mr chair School Board policy provides the opportunity at this point in the meeting to address the board concerning any matter on this meeting's agenda if you completed a public comment card please provide please provide it to staff the public comment will be held in the at the podium in the center aisle and in the front please be advised that the board will not respond during public comment to remarks made by speakers speakers who fail to follow proper decorum in the chambers will be ruled out of order any speaker continuing with such remarks will be required to relinquish the microphone for board policy 1.11 and may be removed from the chambers there
154will be one warning for board policy 1.11 the time per speaker is three minutes you will find a countdown on the big screen in the front of the room once your time has elapsed the microphone will automatically shut off please state your name when you approach the microphone and I will call you five speakers at a time Mr chairman there are four individuals that will like to address the board about this briefings agenda thank you is there anyone the audience that has not signed up for public comment that wishes to make a comment seeing none please proceed attorney Dupree Bruno thank you well the following individuals please line up Dr Doug Santini Sharon McGill Edward draft Betsy Vaughn you have are we able to get the timer up okay thank you want to restart his
155clock for him please reset the timer am I supposed to do something with this okay good afternoon board members and Dr Bernier and happy school choice day that's what today is so you were talking about some things that were very important first of all I want to thank every board member that's contacted me and we've sit down and had a talk a couple of them I've had a couple hour talk with me and gone through some of the things and you have discussed many of them in the process and I think that's really speaks well I would be willing to talk to any others that could give me a few minutes and because I've had a lot of experience in the county but I've also had a lot of spirits with boundary changes and things
156going on that you're dealing with first of all when you look at the proximity plan for the area around North Fort Myers Academy you've only put three schools in the choice system and which I think is a little bit unfair this because of the program that set North Fort Myers Academy I think we need to have more students available to go to to be part of that and I look at some of the other areas which some of them are 20 miles long and this one when you look at it there's not that much construction except out around Bayshore and Bayshore has several empty classrooms so the people that are living in these neighborhoods are not sending their kids to the public schools in that area when you look at the things I see that's
157affecting this with the like you have about 180 kids coming into the middle school that is different from the elementary are these kids when they come in to the Middle School this year gonna their siblings or they're going to be able to come too so that's a question we need to look at and talk about because they would like to come as a family when you have a KDA like you were doing with caparetta I think that would be an outstanding thing to happen because it lets the students stay in a school for nine years without moving without worrying about going down to choice and I think that's very very important I was listening to some of the other workshops I was listening to Dr Bernier and he said the there's no requirements for elementary
158so it's different but it's not the way this was set up and the county was there was art schools in every Zone elementary through middle through high at first it was just in the South Zone and Dr Browder spread it out and he conned me and to go into the Suncoast area and I was screaming and yelling but I went Dr Santini the time your time has expired Mr Santini I'm sorry we need to move on to the next comment Please Mr Santini yeah no we need to move on to the next please I'm sorry we need to move on to the next one you've passed your time good afternoon I hope your trip to Tallahassee La Tallahassee last week was beneficial and productive for the district first thing I want to start with is
159the coordinator of Safety and Security I was quite concerned as one of the other board members stated that it looked like we're lowering the standards for that position why for a Safety and Security position and a management oil coordinator management position would be we willing to settle for something less you should always shoot for the best person possible for the job you might not ever get that person and you might have to step back and reevaluate but these changes to the qualifications just do not make sense a bachelor's degree pretty much in anything and only three years experience as we've talked before when you're in a job your first year in a job you're just learning and so really somebody would be coming in with only two years experience and if you look at all
160of the requirements and skills and functions of that job I would say that seriously needs to be reevaluated the next thing is the policy 2.18 and 2.181 some of you know I'm very familiar with 2.18 and so I laid them side by side and tried to figure it out and see what the differences were and as stated everything is all jumbled together it's really hard to separate things and from a perspective of being a public or a parent you just can't it's one paragraph is this another paragraph is this and it just is not consistent I have to say though that I really did appreciate the form that was developed for the Appeals which was very extensive but where is the policy the same form for the challenges we need that same type of form
161to be included for challenges with all those same specifications and needs to be filled out completely and it needs to be part of the process and as far as Hector cafrata I think C makes the most sense for the district both for the students and for the taxpayers and logistically while they're in the trailers the new school can be being built and then the old school I'm not quite sure the logistics but the old school can be torn down when the kids aren't in the trailers or the Portables not trailers so that really makes the most sense thank you foreign board members superintendent Bernier and staff Dr Edward F grass MB I'd like to present some comments on the policies that have been addressed this afternoon specifically policy 2.181 instructional materials program first I would
162like to make note of line 121 where it says any instructional material containing pornography or otherwise prohibited by FSA 47.012 may not be used or made available within any public school further line 343 also prohibits the perfect material that contains pornography these include materials that are currently in use in classrooms AP courses and books present in the school libraries one specific example which I previously cited during public comment The Bluest Eye by Toni Morrison there are additional books in question referring to a list from citizens Florida Florida Citizens Alliance which fall under the auspices of 847.012 and clearly violates State statutes regarding pornographic to continue with policy 2.1 A1 regarding new curriculum review and evaluation line 184 is in regard to reviewing the new curriculum and this has been changed from policy 2.18 but 184
163says after receipt from the superintendent of a reviewer's electronic report and recommendation the board shall publish a notice indicating the date time and location of an open public hearing to address and recommend instructional materials the public shall have an opportunity to provide public comment at that public hearing so my question is will the public have sufficient advance notice of the materials being reviewed and have access to the materials being considered in the past I was part of public committees that had no Advance access to the material and only a short two to three hour Hands-On review often that material was not reflective of the curriculum being adopted while the time provided to public reviewers was insufficient to review all the material presented in the curriculum reviewers report and recommendations be made public for review along
164with the proposed curriculum how will this notice of public hearing be published and by what method will it reach the majority of County residents and parents interested in participating in this review process will District staff accept the input of participants at the hearing or will the efforts and recommendations of the public reviewers be for not having no influence over what educational curriculum is ultimately selected I would appreciate answers to these questions and I would thank you for your thank you and that oops we have one more don't touch microphone here good afternoon board Dr Bernier Kathy attorney Kathy Dupree Bruno I'm Betsy Vaughn I am speaking in support of the recommendation that was brought forward to the board from the equity and diversity advisory committee about the school district changing from the present one single
165member districts for five of the districts and two at large districts Lee County School District covers over 1200 square miles it has 95 traditional schools plus 23 Charter Schools every school board member as was mentioned represents the entire District however typically districts one through five which are the current single member districts are particularly attuned to the unique needs of their District constituents it's much easier to develop special connections with students staff and school culture of 23 or so schools then to develop those close bonds as an enlarged member with 118 schools that span a vast distance seven single member districts will provide a deeper understanding of community concerns for the individual board members in that District in those districts the smaller districts will also enable local stakeholders easier access to their area Representatives have flop
166they impede racial ethnic or political minorities from seats at the Deus for instance county-wide districts can allow a majority voting block to defeat minority group candidates even when the group has a sufficient share of the population to deserve its own representation large at large school districts also enable disproportionate representation for example between 2016 and 2018 three of the seven board members resided in the Estero Bonita Springs area I was quite disappointed with the way the briefing was handled by Mr Fisher down the board discussion rather quickly and he did so on this particular topic without an actual consensus taken from thank you Miss Vaughn your time is up that concludes public comments sir thank you everyone for your thank you everyone for your comments appreciate it let's go on to good of the order and
167board comment I will start with Ms juvenile I'll be quick I just wanted to say that we had a very productive it was brought up that about our Tallahassee visit and we had a very productive two days and I really appreciate all the work that went into getting there with Miss Dr Carlin but I also want to just wanted to say something because it was really important the leadership with Dr brunier was a first time ever and I felt that his leadership there really impacted our visits that and that we never had before so I'm excited to see how things go in Tallahassee in the upcoming sessions I attended the Norfolk Myers Academy a sensory room a grand opening yesterday and that was exciting to see I would like to see that more schools have
168opportunity there was a teacher from Littleton I think which was from Littleton right and she was there checking it out for her school so I think it's something that we need to see more of and how we can help our other elementary schools and schools have this because it's also a room that I think that even the middle schoolers May take participate in because it was pretty cool so that's all I have thank you Ms Patrica I have none thank you Ms Jordan thank you I put something together regarding Tallahassee as the legislative liaison would you like for me to do it now or later probably now probably now okay Okay so five of us attended Tallahassee plus the superintendent Miss Dr Carlin and our lobbyist gray Robinson we had over 21 meetings set up
169which were divided amongst us the objective was to connect with State lawmakers in order to gain support for the school district of Lee County and to advocate for the most important issues we had several opportunities to meet with several legislators of the senate committee on resilience which is a new committee from my understanding the house education appropriation and the Senate appropriation staff directors Senate President pasadoma and some of the board members met with our local legislators well I well I had opportunities to meet with several legislators from Miami and other areas who had been affected by devastation they understood that some part of Lee was Ground Zero and they listened intently and want to help representative roach is willing to sponsor one of our local legislative priorities which is are the increased student achievement the
170CTE on the house side while Senator Martin hopefully will be sponsoring it on the Senate side some of us attended some of the committee meetings in between schedule meetings it was extremely busy two days where we certainly got all of our steps in why spent Quality quality time speaking on behalf of the district and building relationships also I have the appropriation request and sponsors so the we had a request for specific appropriation projects to expand the CTE program which again we are a sponsor would be Spencer representative Spencer roach with Senator Jonathan Martin on the on the Senate side the request for our Safety and Security technology we're hoping that representative Tiffany Esposito will take that on again we're looking at Senator Martin we're going to give him everything on the Senate side request for
171appropriation project to provide expanded after school activities to ensure that to provide a safe and secure after-school environment representative Adam Botana we're asking him looking at him to sponsor that why we are still working on securing sponsors for the request for allocation to provide special Capital funding for the district documented losses related to the hurricane as well as a request for a special allocation to provide operational funding for the district documented loss related to Hurricane Ian and that's where we sit right now but it was really I thought it was really well done and as Miss Gianelli has stated Heaven doctor Bernier there was fabulous because he had all the answers all everything in his head and I think that it allowed it just made us we were a team there with that respect so
172I really appreciated that so that was my report on the legislative part and then the other part would be as Miss giovannelli stated we had the opportunity to do the to share in the ribbon cutting at North Fort Myers Academy for the sensory room which she has already explained was fabulous I wanted to make sure that I also had the opportunity to attend the student enrollment Showcase with several of the other members here and I'm sure they'll speak on that I thought it was great speaking to parents speaking to the students who are looking at their schools and having everybody in one area but also knowing that they have already attended the other their schools that they're hoping to be at it's always great seeing a little bit of competition I felt that it was
173a competition let's see and then this coming Thursday I wanted to make sure that this is a public service announcement we have our all-county dance showcase Thursday the 26th at Cyprus we have our North Fort Myers Academy of the Arts is having an upcoming production of Madagascar don't miss that and then also Art Fest is coming up on the third the fourth and the fifth I'm sorry the first through the Third which is downtown Fort Myers and a lot of our students will be participating they do the chalk blocks so that they take over the streets and do do all kind of artwork on there which is always fabulous and we have the recycling projects that will be done which we've seen some of that already taken place at North Fort Myers Academy where the
174students are putting together and what they're going to create it's going to be fabulous so I would advise everybody too if you have the time to go downtown and just represent our children and look and see what they're doing it's it's pretty fabulous and that is my report thank you Mr persons yes I also attended the ribbon cutting that was quite something to see the students and the teachers and the new sensory room on the Tallahassee trip it was outstanding but the most important thing was every legislator we talked to on both sides of the aisle said they had our backs you know they're very aware they've been through it's definitely a nonpartisan issue so that's exciting news we'll have to see how everything turns out and finally on the Saturday morning during where all
175the high schools here that was very impressive but also what was impressive was the staff here enrolling them on the spot they were all set up to do that and that was a great idea I wish I had thought of it but you know sometimes I can just take credit anyway but no it was it was really good thank you Miss Langford Fleming I just wanted to just add a few things about the Tallahassee trip apparently it's been many many years since we were able to get up there and to speak with legislators and state representatives and especially ones from our local area what I thought was really exciting was while those state legislators and representatives live in our area we're able to talk as staff who we can't really seem to get to at
176the tip of our fingers so that was wonderful I do think that there was a lot of lean in conversations I heard chairpersons say many many times while we are no longer the headline we are still dealing with a lot of hurricane damage and I think just being there in person with such a great group of people and the superintendent did such a great job at knowing on the tip of his fingers what whatever was being asked so that's the only thing I just wanted to add so thank you I know that took a lot of work here at home too to prepare us to be able to get up there and make a smooth report to everyone so thank you very much for that Ms Morgan let's see I did I first of all
177I want to thank Debbie Jordan for reviewing the entire day or two days at Tallahassee because I wasn't able to attend so it's nice to have information about who you spoke with about what so I appreciate that thank you I also want to thank you for covering edac for me last night there was some confusion the edac meeting to which I'm the liaison was not on my calendar and Debbie just happened to be here and so she jumped in and attended on my behalf and took some copious notes so I'll know exactly what's going on and then also Saturday morning I went to the enrollment or the high school event and I thought it was really well done and like chairpersons I didn't expect the special services that they had set up for families and
178Stu students there I just thought it was really well done I hope though in the future that it's done before the open houses so that people will maybe have a better idea of which open houses they want to attend but I think the my sense was I was there sort of for the middle session my sense was that the staff was excited by the prospect of doing this again maybe modifying it a little bit but felt that it would be helpful in terms of student School selection so we'll see anyway those are my comments thank you thank you a couple things I was able to take a tour of Ida Baker High School as well as the Cape Coral Technical College and I was able to meet up with some of the Cape Coral leadership
179class from the Chamber of Commerce and Dr Bernier was kind enough to join me at that I think it turned out really well and gave A New Perspective to that appreciate it also the aforementioned going out my first teacher of the year at Hans Marsh Middle I really enjoyed that congratulations to Stephen McGinley that was really cool and that was really great to see they're really doing some great things over at that school also wanted to get into Tallahassee I think everyone up here I really appreciate their help we did a great time we did a great job I think up there there were a lot of doors opened a lot of people listening I really appreciate the local delegation the house senate leaders and the governor's team they were very receptive and wanted to
180help out especially with what has gone on down here I appreciate the leadership of having Dr Bernier up there with us especially in the room next to me that helped a lot thank you for saving me as well as chair person's leadership up there as well so and I also want to give a special special thanks to Dr Carlin for dealing with us and getting everything in task and in order for up there I really do appreciate that so outside of that I just want to remind everything everyone there is a run for prevention this Saturday the 28th one you know would like to sign up for that and what we can also call it a walk that's probably what I'm gonna do thank you Mr superintendent do you have any comments what Lee County
181drug free coalition Mr chair I have no comments at this time attorney Dupree Bruno no comments thank you okay thank you we will have a student performance tonight at 5 40 p.m followed by our acts meeting at six o'clock seeing no other business come before this board the meeting is adjourned at 3 49 pm thank you
