of course. Okay. So yeah, tomorrow And we'll call to order the May Groport Madison Local School Board of Education regular meeting. If we could do a roll call, please. >> Here. >> Miss Zimmer is absent. Mrs. here. >> Miss Walsh >> here, >> and Mr. Kersner is absent. >> Can I read a statement from Ashley Zimmerman? >> Yes. >> Okay. Fellow board members, colleagues, and community members. I sincerely apologize for my absence this evening. There are several items on the agenda which I hold strong views on, and I regret not being able to participate in the discussion. I encourage the board to set aside personal differences and remain focused on what is in the best interest of our students. While I'm not present to respond to questions regarding policy IGCG-R, I have asked Jamie to
share additional information from an email Kathy sent on Monday outlining her questions and concerns. I do have concerns regarding the timing of that communication. As a board, we have expressed a desire to conduct efficient meetings. Submitting questions the day before a scheduled meeting can create unnecessary pressure and tends to extend rather than streamline our discussion. Given that this is the second reading in of the policy and the policy has been available for two months, the timing raises concerns about unnecessarily uh delaying particular particularly when initiated by board leadership. I understand there is an executive session scheduled for this evening. If it is a continuation of the previous meeting, I hope all parties are present so the matter can be addressed without further delay. If all parties are not present, I re recommend postponing the executive
session to ensure efficiency and avoid redundancy in future discussions. I would also like to note that the upcoming budget considerations will require careful review. Some of the contracts on tonight's agenda may present opportunity for cost savings with minimal impact to students. As always, our primary focus should remain on serving the students effectively. If possible, I would like to attend executive session virtually. One more. Hold on. Additionally, I request that the board consider scheduling a special meeting to allow won't state the name the opportunity to share her concerns. In my view, she has made every effort to follow established channels without resolution and it is appropriate for the board to hear her perspective. Providing the opportunity to be heard is important. If there is any question about this, any question about the need for legal counsel,
I ask that this determination be made by collectively by the board. >> Thank you. I might have had too much to review and that was a lot to take in, but um I I wish actually the best in what she's going through right now. Um, we go do the pledge of allegiance. On to item four, adoption of the meeting agenda. Second, first second. So, I would like to make a recommendation that we move um the consent the meeting minutes and consent agenda after executive session. Um that was advice that was sent to us. Did you all get the emails from Brendan? I have a copy of it here if you guys like to see it. So, sorry. Um um so that would be >> so you're just saying move the executive session I move the
executive session before consent agenda. Is that what you were saying? >> Yeah. Um but when I spoke to him and Steve recently we said just moving it as long as uh we want executive session before the consent agenda and so that everybody can see everything uh all the business that we have beforehand. It would be fine just to do that and then that will put the public who are here to um listen to the other items in a position not to hear those items. >> Okay. because I thought you said I just was making sure I was clear because the email talks about moving it up, but I thought you stated to pull out the meeting minute notes. So, those are two different things. So, that's why I wanted to make sure I was clear
on what you were saying. >> Yeah, it doesn't say the meeting minutes, but I'm going to recommend it just because that's going to be another one of those discussion items or whatever that might happen. And okay, I just thought it would be those can go afterwards because usually the meeting minutes are in the consent agenda anyhow. So if that would be all right with the fellow board members to move D and D no DN to after executive session right >> so you're moving what now >> yes and >> so D and E are going to after executive session >> yes I move that we move the item D and E after item. >> Okay, >> I got it. >> We'll need a second. >> I'm sorry. That's Dr. K. 30 seconds. Okay. So, I moved
I moved the minutes. and D to after the executive session. >> Yes. >> Do we need to vote on that that meeting? No, >> I didn't think we did because the agenda had been approved, but that's not what we >> Okay. Thank you. So um we to adopt the agenda as we are we ready for roll call or what are Mrs. >> Hi, >> Mrs. Herbert. >> Yes. >> And Mrs. Walsh. >> Hi. >> Now we're on to item B, public participation. And we have one speaker. Let's see. Is she here? >> Oh, there you Yes. Come on. I didn't see you. I didn't see you over there. >> I'm sorry. I thought you did that spiel. >> Oh, I got to read the rules on Okay. Um, guidelines for public participation. A public participation
will continue in accordance with the policy. B speaker must state their name and any group that they represent. C speakers are limited to three minutes each. B comments must be directed through the chair. Um the public participation is for comment only and may not be used to name district employee. F the total participation period is limited to 30 minutes unless extended by vote of the board. All meetings of the board and the board appointing committees are open to the public. And thank you. >> Good evening members of the school board, educators and families. My name is Judy BB and my address is 5136 Sand Court. I want to personally thank the school board for their generous donation to the color run. It was a huge success that would not have happened without your support. I
will not be available for the color run presentation next week, but I wanted to thank you for your continued commitment to our students. I picked up this sign at a yard sale a couple weeks ago and I thought about the powerful statement, together we have it all. In our schools, it's easy to focus on what we lack. But when we shift our perspective, we begin to see something stronger. The collective strength of this community and our city. Our teachers bring dedication, creativity, and heart into the classrooms every single day. Our students bring curiosity, resilience, and potential. Families bring support, values, and encouragement. Our city brings partnerships, services, and opportunities that extend learning beyond the classroom. And this board brings leadership, vision, and commitment. Individually, each is each of these is very important, but together they
form something complete. When we collaborate and work together, when we listen to each other, respect each other, and work towards shared goals, we create an environment where students don't just learn, they thrive. Success in education is not built by one group alone. It is built through partnerships. Together, we have it all. Doesn't mean that everything is perfect. It means we already have the most important pieces. people who deeply care and are willing to work together. So, as decisions are made and priorities are set, I encourage us all to keep that idea at the center. Let's continue strengthening our connection between our schools, family, and our city, supporting our educators, and uplifting our students because when we truly work together, there is nothing we cannot provide for them. Lastly, in our schools, there are positive quotes
to help encourage us to stay focused and positive, just like this one I found in my principal's office. If you can be anything, be kind. I would like to rem recommend that we place a couple positive quotes in this room to remind us of that. Together we have it all. We are all cruisers. Thank you. >> You guys can keep that. >> Thank you so much. >> Thank you, Miss BB. I wanted to also thank you guys and the the staff and the parents who helped put on the color run. I know I sent a message to some of you all as I couldn't make it due to work, but it looks so much fun and the pics and things that our comm put out. Thank you guys for sharing that so that the community
can see our students in in in what in their true form and it's just awesome. Thank you and we look forward to your presentation next week. Thank you to item C. uh boarding new business. I move that we take a five minute recess to give Mr. Commissioner second >> five recess first Kathy second Mrs. Denber >> I would al like to state that any other time going forward if we having someone that's late that we just say give the same courtesy and be kind. >> So Herbert >> Yes. >> and Miss Washington. >> Yes. Five minutes of six. We do. That's so session. On to item board item new business C1 board policy review agenda preparation and item requests process policy B DDC. Um Ashley had requested this be um added to the agenda as
she wanted a discussion and a review of agenda setting authority including clarification of the process uh for board members to request items agenda items and identify identification of the ultimate decision maker regarding if an item is placed on an agenda. And then we have BDDC is attached to that discussion item. Anybody have any comments about that? I do think it's important that we come up with a um clear guidance on how this process will play out, who has authority to do what, and how do we operate collectively because my experience since January has been um that in situations you as the board president has had the ultimate authority to approve or deny things from being put on the agenda, which my understanding is that's not how we should be doing things. So, I guess just
clarifying what the process is and does everyone have a say so in getting things on the agenda? >> Any other comments? >> I was just waiting for you to respond. >> I'm just waiting for you. >> I'm waiting for you to respond to her statements because I have not been in those meetings to understand what the the experience is. I just wanted to hear what that is since we're having the discussion as Miss Herbert just mentioned. >> So we would follow policy BC. >> I'm sorry. What? Could you repeat that? >> Okay. So, I'm going to read a statement and I'll pass it down, have it attached to the agenda. So, I want to clarify this from a process standpoint so we're all aligned. Under our policy BDC, items may be suggested by, and I
quote, board member, staff member, or citizens of the district, and the superintendent in in consultation with the board president prepares the agenda. In doing so, we also take into account the superintendent and I um particular considerations such as the length of the agenda, timing, and when appropriate, guidance from board counsel. That said, no board member is prevented from bringing forward an item prior to adoption of the agenda. Any member may make a motion to add an item and the board can decide by majority vote. that ensures both an orderly process and that the full board retains final authority and if you did a time check might appreciate it. Thank you. >> Okay. But I guess my statement or question before was the ultimate um approval or denial of set suggestions or um things that people
want to put on the agenda. Like for example, in January um model was supposed to come give a presentation. it was taken off of the agenda and for three months after I in each meeting that I was invited to asked for that to be um a priority. So it took three months for it to be added back or two I I could be misstating two to three months to be added back on the agenda per your discretion. So the conversation is who has the ultimate authority to decide what we discuss as a board and I would again say to look at policy and see what the policy says. So when we made that decision we moved all of our presentations to the second meeting of the month. Um the UN was not able to make
the second meeting or the I think I don't know if they did in February. I can't remember. Um >> I have a question. Is it possible for you >> put it on there? I'm not sure what we did. So, >> Miss Walsh, if you could speak in your mic because you sound like you're in a tunnel. Um so, it's not clear. So, if you could lean in and actually speak into the mic or bring the microphone down because you sound like you're in a tunnel um just from where I'm at. So, that'd be great. Thank you. So, you didn't hear what I said. Is that what you're saying? >> I'm saying it wasn't clear. I heard some of it, but you do sound very far away. And I don't know if there's something else because
everyone else's mic seems seems very clear, but yours and we've got members of the audience also concurring with my statements. >> Yes. started saying again that we would probably follow policy BDDC that decision was made and if anybody would want to change policy BDDC then we could do that but the agenda was long we didn't we had a long executive session planned we're trying to be more um respectful of our staff and our community members and so we moved the presentation to the second meeting and the UN was not able too. I have multiple emails that I have them with me if you would like to see them of um I can get I can send it to you right now of people requesting things to be put on the agenda and those items being
added to the agenda multiple times. >> Okay. not to belabor the point. Um and if if allowed because it's me, you um superintendent and treasurer involved in the process, I would love to hear other people's perspective or experience or if they could recall what the circumstances was when things were being removed if it was a discussion or a veto by you. Um and the model unum was just one example because the issue then became not having any student presentations at board meetings as this is a business meeting and that that should be acknowledged at school events >> that did come up as a topic. Um >> yeah and it was in one of our meetings. >> It was one of our meetings where where the recommendation was removed. just don't want it to look like
I'm nitpicking when I really want clarification on who has ultimate authority for approving or denying what gets on the agenda because I have brought up things that you disagree with and they did not make it on the agenda not because of time and was this during the agenda prep I understand because is this during the agenda prep session like outlined in B DDC is that when that happened is that when you're asking for things is that during the agenda preparation Say that again. >> When you're saying that things have not been added that you've asked for, is that during the agenda preparation where you're in the Okay. Yes. Correct. >> If we have a full agenda, then we don't add things to it. If that we have a we send a draft agenda if anybody's
unhappy with the draft agenda. I have not once had one member of the board say, "Hey, I don't like this draft agenda. I would like this added to the agenda." So now you're up here. It's it's you know >> in fact our policy says the vice president the president is doing the agenda not the vice president and the vice president doesn't even have to attend that meeting or be invited to that meeting. But I definitely have been trying very hard to be cooperative with um and invite everybody. I've been accused of not but I that I didn't send an invitation and I had the invitation the Google meets invitation for that meeting and the vice president was invited. She didn't respond and she didn't show up. But during a board meeting, it was said that
I didn't invite that person to invite her. >> That person >> only five of us. You know the name. >> And this is the second time I've been accused publicly once I witness that attest to my statement. There's nothing in accurate being stated point of order yourself as well. >> Yeah, I would say that. >> I'm sorry. I don't even know. I can't even tell what's going on right now. Everybody's talking question. >> The question was, who has authority to approve or deny things being added to the agenda? What's the question? >> Okay. Thank you. >> So, I'll give a perspective. Um, I've been here now. I've served for about six years. The last two years, um, I experienced very similar things to what you're describing. Uh, no responses to emails. I would even publicly
ask for something to be added to the agenda on the next meeting and it would dis it wouldn't be there or those reads would disappear, etc., etc. So, I think there's room there's definitely been room for improvement. uh in in recently at least I can reach the president. At least I can get responses and be included. So I would say it was worse before than it is now. >> I hear you. I you know we've talked about this before. I wholeheartedly apologize for whatever you experience. Um coming into a new year, new board, you would think that things wouldn't have to be repeated. And at a bare minimum, get my name right. Da Herbert, vice president of Groport Madison School Board. It's not difficult. >> I would just state that in the past, just to
give context to your question you had, Miss Herbert, regarding kind of how things went before, um, and I heard Miss Walsh stated that there was invitation sent. Sometimes we are put in meetings or we could be called in because of course we all have a 9 to5. So in those instances, I hope that you're maybe making a phone call, you know, hey, agenda prep is happening. I didn't see, you know, for with you all being the president and the vice president is what I'm speaking of for those agenda preps to ensure all are there. So since discussion, I'm not saying it didn't happen, but that's just another suggestion um in a way to ensure that the vice president is present at those meetings and collaborating with not just one schedule, but both schedules just as
a suggestion. Not accusing you, Miss Walsh. I'm just making that as a suggestion since we're having a discussion. Thank you. >> So I apologize if I offended you, board member Herbert. I will say that here's the email that you said you did not get for an invite to a meeting that you went publicly and said I was not being cooperative and I didn't invite you to that meeting. You were invited to that meeting. Here it is. I have another meeting that you that you accuse me of not appointing minorities to committees. It's and that was not even true. You had already been appointed to a committee. So, I'm just getting tired and I wish people would listen to what Miss Judy Beauty said and just stop, take a breath. You're being invited to meetings that
I don't even have to invite you to, but I am because I want to get along with you and I will continue to turn the other cheek and you can keep making false statements. I'm fine. >> Okay. So, for clarification and for the record, um the first meeting I wasn't invited to. you invited Ashley to because you wanted her to actually be the VP pass. Can I ask a question real quick? Can we get a copy of that if we could ask for that to be pulled um that meeting? I would like to see that please. Merrick, my apologies. >> No. Additionally, I did get a meeting invite, but the process we had been doing for months prior to that was we would reach out via phone. Um we didn't have that. I saw the
meeting after the fact. I reached out to superintendent who then let me know that you didn't have time to reach out directly. But that was after the meeting had passed. As soon as I realized I missed the meeting, I reached out. So again, we kind of modified or changed the way we had been preparing meetings. Additionally, I was not assigned to any committees. What happened was you started assigning um Latoya and Ashley to a committee and then we stopped it because John wasn't here. I know it's easy to get us mixed up, but Latoya was assigned, not we a minority. >> So can we know this session? >> You never answered the question. >> What's the question? The question was, who has ultimate authority to approve or deny things getting on the agenda? >> Follow
policy v uh DDC. And if a board member wants to make a change to the agenda at the board meeting, they most certainly are able to do so. If you would like to um send this policy for review uh that to the policy committee, I would recommend that would be great and they can review it. I will say that our past policy under this had only the president attending that meeting and the reason being is when you have a meeting and and as far as the second meeting we have how many days three days after the meeting to get that scheduled right Jeff Jamie to get that out >> I would say just trying to look forward we have a we're talking about policy and structure and I appreciate that because I'm a policy and
structure person but um we have many ways of getting things on the agenda. And the regular meeting today, for instance, uh if if I had shown up here with something on here that I wanted on here, I could either address it at new new business or at the end or I could ask for it to be added and we could vote on that. Um but beyond that, um one idea that I had and I think uh maybe it doesn't set well was is that different people be brought in in the agenda prep throughout the year. sometimes, not maybe every time, but so that other board members can see the process as well. Um, that was a thought I have. I don't think it I don't think it has to be the same two people every
time as long as we're open and communicating about what we want. And I know I'm not always on top of it as as good as I can't could be. But I do think we have opportunity and and as you know, any two board members can call the meeting or special meeting. So we have lots of flexibility on how we can get agendas that we want if um so I think we just have to be patient and flexible and and try to work together and communicate and uh I think we should probably go forward with specific examples. Um if you put something out there and it's refused and there's no explanation, then let's have a discussion on that instead of looking backwards and um fighting over things we can't change in our past. So, I'd say
let's just try to work together, communicate, and uh get out front and and and plan these meetings as far out as we can. That helps with uh the communication as well. People might see things when the agenda comes out early enough and uh they can make additions. That's just my two cents. Thank you. >> Any other comments? I have more but I know we have more things to cover but I would rather just use the time to do student things. So thank you. All right. So we're on to item C2. the board of education communication protocol and administration and legal with administration and legal counsel. This was also a request of Ashley to the final meeting. Um, she wanted that to be discussion review of designating a specific board member to serve as a primary
point of communication between the board legal council and district administration to ensure consistency, transparency, and proper oversight. Any comments? I'll be honest with the shuffling of your papers and your microphone and you're not speaking directly in it. I really didn't hear what you said and and I'm being honest and when you're speaking if you could speak directly in the mic and not move papers because it is a hindrance in hearing exactly what you're saying and actually speak up and annunciate please. >> It might help if you didn't if you sat where board members were intended to set instead of all the way down on the end. It was never intended for a board meeting member and that also affects two people on this board that are extremely hard of hearing. So you've contributed to the
problem you're complaining about. >> Actually, John, thank you so much for bringing that up. You're actually the reason why I moved with your iate behavior that happened after the board meeting in February, which I filed a police report on, which is available. So that's the reason why I moved, but I never wanted to make that public. But since you wanted to accuse me of moving and not adhering to your disability, that was not the reason. The reason because I didn't feel safe. Thank you. >> Yeah. >> So, I'll read that again so that Miss Don Oberer and anybody who didn't hear it can hear it. Um before moving to item C2, board of education communication protocol and administration with the administration and legal council. And what um Ashton's email for her request said is discuss
discussion and review of designating a specific board member to serve as the primary point of communication between the board legal council and district administration to ensure consistency, transparency, and proper oversight. Are there any questions or concerns with this? Um, I think I don't want to speak for anyone else. I'll just speak for myself. I think the big issue and something that we need to address is just the lack of trust and transparency. It seems that legal is utilized or weaponized against the board instead of used um responsibly for things that we actually need not things to like mitigate frustration or to stop things from happening internally. So I think the request is coming from a place of making sure we all have a liaison that we can trust um that has the best interest of
the district and the board at hand. >> Yeah, I think I think um I'll comment on that. If you look at the legal fees that we spent, I think we spent over a million dollars. Is that right, Adam? Last year, which is just abhorrent. Um, and I think somebody just spoke to some of the ways that happens. Um, if I Yeah, we're trying to keep meeting short. And if I show up at the back of the room and complain from 80 feet away from you, you're not threatened and you've never been threatened by me. That's just one example. But I can give examples of a $50,000 lawsuit let by one board member without any board authorization which was dropped because it was ridiculous and I don't even know how it ever got paid by our
treasurer. Um, and authorizations by the board which were for defense which were turned into offense which turned into $100,000 actions which were dropped because they were ridiculous. And um I think at the core of this is a is a need for um a less embedded law firm that uh would be more neutral and protect us from these types of extensive litigation and I think hopefully we have better we I I just hope we can get this down. What would what would you say Adam is a should be a typical year for us for legal fees compared to other districts? the district car size 3 350,000 a year. >> Yeah. So we we're tripling that and that's part of being latigious amongst ourselves is a big huge that we've probably spent half of what you just
said on that and then also u being latigious all around the place against employees to the district district to employees. Uh, and we even have a subject on here that could that would um probably possibly fall into that future category. So, I agree with you. There's we need to be more efficient. One of the things I pointed out, I don't know how it would work. I'd love to see it. A long time ago when I was on the board um and I was president, I was in close contact with the prosecutor's office and the person in the prosecutor's office that taught open meetings uh training and uh there was no cost when a call would be made to make sure an item was correct for a motion or we were doing the correct reason for
executive session. And I think we need to get back to that. We also need to educate ourselves and be careful not to violate open meetings. Um, and that will keep us out of the woods. Um, and there's another item on the agenda today that will be an example of that. Uh, so we have examples right here today of items that very well may lead to wasting legal fees. And I think we've already heard an example. Um, and uh, I think we need to get away from that. And I think we need to find a firm that will help us stay out of that. And also other avenues such as the prosecutor's office that can provide us legal advice without without paying $350 an hour. >> Does anyone else have any comments? Um, I'll just share
that I was told by Adam Miller when I asked about this earlier that the prosecutor's office has conflicted out uh and could not provide legal advice for us. >> For what matters, please? >> I I don't know the specifics, but they he checked with the prosecutor's office and told me they were conflicted out that they could not do that. So the state law and statute is that they are de facto attorneys. That's written in law. So I wouldn't understand how that would be possible. It might be specific cases where the prosecutors are involved. I don't know. Um that would be unusual and not inconsistent with my experience or what the higher revised code says. >> So I I have a statement if you're done. >> Second. I have a statement if you're done. >> I'm
done. >> Anybody else? Okay. So, um under under current board policy BG, board staff communication, the board is already establishing communication structure. The policy clearly states that the line of communication between the board and staff is through the superintendent. For that reason, I do not support designating a single board member as a primary point of communication with administration or legal counsel. That approach would conflict with board policy, create the appearance of individual authority outside of board action, reduce transparency, and limit full board awareness. It is it also raises concerns under the open meetings act as routing communication through one member creates a risk of discussion occurring outside of public view. I will say this if there are concerns that individual board members are engaging directly with administration in ways that go beyond the role of
the board board member that is something we should address. Our policy is clear and it applies to all of us equally. The solution however is not to formalize that structure by designating one member. The solution is to follow the policy we already have in place. The board acts as a body and our processes must ensure transparency and equal access to information for all members. For those reasons, I would not support this approach in that to Adam to add to the minutes. Thank you. Are there any other comments on this issue? Hearing none, we'll move on to um C3 fire uh fire safety fire and bus lane blocking at Sidelia. >> I guess I have some questions along the lines. Um, I've I think we've all seen pictures and videos of of vehicles um of people
parking and in the fire lane and exiting their vehicles and going either into or up to the door. Um I do know from our fire chief that um these buildings exist have existed for a long time um greater than 40 years and they weren't set up exactly as we would if we were building them today. However um their feeling is that if people are in cars in the fire lane um and they come up with their horns and sirens as people will exit. It is a problem. However, uh if people are exiting their cars, so I just want to bring two things to the administration's attention, which I think hopefully they already are. And that is um one uh it is a problem if people are exiting their cars when they're parked in the fire
lane, I believe. And two, I think it's dangerous that we have people exiting the driver's side. In general, most schools have a safety policy that says the students will exit only from the passenger side. Otherwise, they're potentially stepping into the um pathway of buses or other cars that are coming by. So, I think we should definitely take a look at that. Um and then additionally, um the alternate is letting kids out in a parking lot. And I know, you know, from personal experience, that can be very deadly. Um, parking lots are not the safest places for kids. So, um, I would hope that we could establish lanes at the end of the building as well, if we haven't already, and cones and make sure we're taking all the safety precautions we can to get the
kids out of the um buses safe out of the um cars safely and also not block buses and not let people exit their cars. so that we are potentially blocking buses and and uh other um uh potential safety vehicles. So, I just I just wanted to bring that forward and see if you had any input, Mr. Superintendent. >> I'm going to ask Mr. Smatty to follow up on that. >> Thank you for that. I'd like to say that that is a priority for us. We do have plans in every one of our schools to be honest with you. Uh we should be very proud of the comprehensive safety plans that we have. Uh we work closely with the police department and the fire department and I love our relationship and collaboration and we talk about
this and they're part of the safety plan. Um they are fire lanes. Even firet trucks can't be in the fire lanes. But out of an abundance of caution and safety, we have our kids take the shortest route from the bus and the safest route to the front door and enter the school safely. So, we have the buses line up, the doors are on that sidewalk side. They exit and they enter the building. Staff's out there. What happens is we've had a few people notice that people don't listen and ignore our safety protocols and decide to pull up because rules don't apply to them and come up in between the buses and drive up where they're not supposed to even when they're told not to. But most of these situations with the pictures that I seen
were after school started and the staff are in and the kids are in and school has started and so these people are coming to school late and pulling up, parking the car, getting out and signing their kids in, which they're not allowed to do. And they have been asked several times not to do that. They they're asked not to do it again. Um, Madison Township is trying to keep a good relationship with their community and they're not interested in ticketing every little thing, but they do ask and um people don't listen. Uh, so it's probably going to turn into a situation where people are going to get tickets. I appreciate that. Thank you. Yeah, you're welcome. I'm I'm also interested if there if we feel there's if the administration feels there is possibly anything to
do different to maybe head off uh any legal challenges that were being threatened with with the individual who has um been not no trespass and I have some questions there. Um, so I believe I read that an individual had been told that they weren't allowed within a thousand foot of a bus stop. Is that is that possibly true? >> Is that possibly true? Yes. I don't know what situation you're talking about. >> The no trust the recent no trespass order that's kind of >> so trying to make controversial. I'll say it that way. >> Right. And and I just want to say look >> is that in is this dealing with the fire and bus? I'm just trying to make sure I'm >> No, this is I guess a separate question. >> Is this separate
from that? >> No, this is part of that. We had an we had a person um who was was uh courting taking pictures of this and arguing over I believe this issue and they were no trespass. And I think there was a couple things in the order that caught my attention that I hope might we might be able to address to eliminate liability. >> One was Yes. >> I had a question for you. Is that in the They were in the fire lane. I just wanted clarity in what you were asking. Is it dealing with the fire? You said there was a issue recently with trespassing. So, I was just trying to um make sure it was following that it was with the fire lane. And if you can give a little more context, please.
>> So, we have we had an individual, the same person who um brought the damaged playground equipment to our attention uh complain about the fire lane issue. and the person is actually a fireman uh for Columbus and um I think he might have been belligerent and unprofessional and uh I don't know what all he did but he got no trespass and so he's bringing this forward and then when I looked at the order I noticed I believe it said that that person couldn't be within a thousand foot of a bus stop which seems more like you know what you would apply to a a sexual predator or something but then I also noticed that the order said you may be you may be arrested if directed by the district and I'm not sure where he
was standing when he was arrested but I'm questioning whether that language was correct or not or whether we should have language that simply authorizes our officer to make arrest at their discretion. So those are the two things that I noticed that I have questions about just and I think from what uh was explained me that uh the reason for no trespass was described to me in a more egregious manner than what is shown in the actual letter. So I'd say maybe we ought to look at the letter make sure it covers all the details and it hasn't become over broad and that the rest was properly applied. That's all I just wanted to bring that forward. And yes, that's all in in in the eyes of the person that's all related to the safety lane
and blocking issue. I'm not sure that it is in reality, but I I just wanted to cover that while we're here. >> I think that's a separate issue to talk about at another time. It doesn't seem to be pertaining to just the that we're talking about trespassing and some additional factors which isn't on the agenda. >> So, as I said, the person was trespassed. Um, and this is my request and and I guess I could have made it a little broader, but the person was trespassed from their vantage point uh about after complaining about issues with the fire lane. So, that is how to me it was relevant. And so yeah, we could make it a separate discussion point, but I have nothing more to discuss on it. So thank you. >> All right. Are
there any other um questions or comments about three the safety fire and lane blocking it? Oh, and James, that poll you said you guys are working with Madison Township to try and get that addressed where right Yes, we're always working with Madison Township Fire and Police as well as as Growport Police. >> Thank you. >> Y on to subject four, work session discussion. So this item which we tried to talk about at the last meeting was just to let the board know that um the individual who we all discussed I believe it was in February that superintendent who we brought forward Steve Fuji is now no longer conflicted and he will um be hopefully attending either the next board meeting, one of the next two board meetings to um talk to the board about what
to expect and what he he can possibly do as a facilitator for the um the work session. So that's the only part of that discussion which any questions about that. All right, on to subject uh five, policy review. Second read IGCG hikeman R. I have a question. This was brought forward by Ashley and I think um she's kind of the driving factor behind this. Do we want to uh table this until she is back or do we want to go forward? >> Here's the email of her responses. >> Okay. Um she did she did have something that she said in her statement at the beginning but um it was a lot and I um wasn't able to >> I didn't >> get all of it in without having it in writing and to review it
more thoroughly. Um, but I I do have a statement I'd like to make that I I had I sent Ashley a bunch of questions, followup questions um because they weren't fully um addressed at the meeting that we were at and I had asked her to check into them and I hadn't heard back from her. So, I went ahead and sent her a bunch of questions um so that they would be in writing and she may be able to follow those a little better. And I appreciate Ashley taking the time to provide the written responses that she did and additional content. But I do have some follow-up questions, however, and I wanted to um focus I want to focus on my primary concern with that policy. Um, our board policy CHA states that regulations are intended
to be provided to provide the detailed arrangements under which the school operates. And my concern is that this rewrite removes a significant amount of operational details particularly in the area of the ratios, the parent access, transportation, field trips, tuition, and clarity around typical peers participation. In several of these areas, what was previously defined in the regulation is no longer included and it is not clear where that detail now resides. So, while I understand the goal is to be more flexible, um I'm not convinced that this revision maintains the level of detail uh contemplated by policy CHA. I also remain concerned that this shift reduces transparency for families and the public and limits the board's ability to effectively oversee how the program operates. I do believe the tuition language could benefit from revision and I am
open to working through that piece. However, my broader concern regarding structure, oversight, and transparency have not been resolved. Uh, for those reasons, I will be moving no on the second read. >> So, to make sure we don't lose what Miss Zimmer um did share, I don't mind rereading it if you're okay with that. >> No, please. Yeah, I was hoping I it said actually she said that Diana would read it, but it doesn't matter. Yeah, we read it at the beginning, but now that we're on the topic, I was just thinking it'd be good to restate it again. >> Okay, >> thank you. >> So, um I guess there was she said, "I revise the language to improve the flexibility for the district, particularly regarding tuition." And I think you've already stated that, uh Miss
Walsh. The goals of revisions was to support the district's ability to adapt to the changing economic conditions while continue to serve students effectively. And so, the her response is, and I'll recap these questions. I believe these are your questions, right, Miss Walsh? Yes, they are my question. >> Okay, so uh the question was can can you walk me through the intent behind the more significant changes and what is the driving what is driving the rewrite at this time? Miss Zimmer stated as discussed during the first read, the prior version included a fixed tuition amount of $50 per role models which is lower than comparable districts. The provision allows tuition to be adjusted as needed based on economic conditions, community factors, and alignment with similar districts while still requiring board approval. Specific operation requirements remain in
place, but exact student counts are removed to reduce the need for possible revisions given the board policy requires um and I think that that's the first question and answer. Second question was given that the board policy requires regulation to provide the detailed arrangements which you kind of mentioned to in your statement miss Walsh under which programs operate how should the board view the revision where the level of detail has been significantly reduced? Miss Simmer stated the revision maintains governance while avoiding redundancy with state law. And so in our policies and I'll pause there. um when we have a policy there is the OIC the OC the Ohio code is attached there. So that's I guess what she meant by redundancy because we do have to site um where we're doing whatever. So I just wanted
to make sure everybody understood that. Um, and where my part is that redundancy by law. >> Go over that again because I it didn't come through quite. >> So the question was given that the board the policy requires regulation. You stated something you know um that is significantly reduced compared to the current regulation and Miss Emmer stated the revision maintains governance while avoiding redundancy with state law. I pause to state that each one of our policies reference the Ohio Revised Code in which it is referencing. So when you go to our board docs, look at a policy at the very bottom. If there's state law that's that's addressed in that policy, you'll have a link to that state law. Or if there is federal law, there'll be a link to that as well. That's all
I was saying. >> I was just following along in her response and >> yeah, I was just making and I didn't want anyone to think when she was saying we're done to see to with the state law that she was omitting it, but that there is a way for our constituents, families or whomever uh staff to be able to view what state law any policy is referencing, not just the one we're discussing this evening. Okay. Um and then she further stated uh >> well my next you want me to read the next question >> I was just making sure I didn't miss yeah requirements established in the OC remain regardless of whether they are restated in board policy hence what I just stated about it being attached um or linked to it excuse me. Then
the the third question um is the current regulation includes more defined parameters around transportation. Was it your intent to narrow transportation to only what is legally required for students with disabilities? And how does that affect access for typical peers and the district's ability to maintain integrated classroom environments? Her response was, I don't believe we currently provide transportation for pair models. The OC does not require transportation for these students, though districts may choose to provide it. The revision aligns the policy with current practices and legal requirements while allowing the district to revisit at a later date if deemed necessary. Then the next question um you asked was the current regulation includes field trip guidance that is not reflected here. Was it your intent to remove or restrict that? and if not, where should that guidance now
be found? And um she stated the intent was to remove this language because it does not reflect current practices. The preschool program does not doesn't include traditional field trips during the school day. Family participation events occur outside of school hours and are op and are optional. The prior language creates an expectation we do not we don't meet or don't need or don't meet, excuse me. And then the other question was the current version includes more specific language around tuition and this version moves to a general fee structure approved by the board. What was the rationale for removing that spec specity and how does the board maintain meaning meaningful visibility and oversight into how tuition levels are determined. She stated the revised policy removes the fixed dollar amount. It retains board authority over tuition. Any proposed
changes would require board review and approval, ensuring continued oversight and accountability. This approach provides flexibility while maintaining governance and control. And I'd say it sounds like when I read when I read this um when you pass this down, it'll be similar to how we approve the um like salary salary tables and things like that. Same concept. when we're doing anything financial there's a table or structure so it would go with the same same process to do that. The next question was with the reduction in specific operational language where are the board administration and public expected to look to understand how the program is actually implemented and does the removal of that detail reduce transparency into how the program operates and Miss Simmer stated operational details regarding program implementation are communi communicated through standard administrative processes
including enrollment procedures student assessments parent orientation and ongoing communication with families. These mechan mechanisms provide transparency without requiring the operation details to be included in board policy. And so when we were you know breaking or whatever that reminds me of like student handbook um how you can look at enrollment information on the website. Um then the last question I believe is I also noted um the inclusion of language such as the best of our ability. How is that standard intended to be implyi applied and evaluated from a board oversight perspective? And she stated, "This language reflects the practical reality that certain specialized services may require external providers. The intent is to acknowledge that the district will deliver services within our capacity while ensuring that students needs are ultimately met, including through uh through outside resources
when necessary." So, and that's when Miss um Herbert also mentioned that the timing of the questions um were right before the board meeting and we've had this policy for two months. So, thank you. >> Thank you for reading. >> I would say um for discussion. I think you've read your statement. Um I appreciate Miss Emmer's um input and I would I don't know if she did. I didn't ask that question if she um you know if she consulted and I'll ask Jamie did you have any uh conversation you know any perspective or what your thoughts were you and Mr. others um on that and then um you know any input if you may have any >> um as far as the specifics to the policy um Ashley did give me this and asked me to
take a look at it. >> Okay. And um the one thing I I think that probably prompted a lot of this was that we had the fixed $50 rate in policy that's been around for forever and were not aligned uh with other districts at that rate. And so I I think that probably prompted the beginning of the rewrite and then try to clean some things up along the way. >> Right. Um and if you know as from my perspective this the simpler um as as long as obviously we're covering everything we have to do. Policy doesn't have to be unnecessary unnecessarily complicated. Yes sir. >> Um so the simpler is is is fine with me. I don't have a hardship with that. But um beyond that I I don't have any strong opinions one way
or another. >> Okay. That's why I'm happy. I just want to make confirm that um and I didn't get a chance to reach out to you with travel and all but thank you for providing that um she reached out and thank you Miss Emmer if you're listening for um ensuring you include the superintendent um when drafting the policy um to do that. I also um think it is a good idea to be more aligned with the tuition across the county um where we can and I assume we take title 20 as well. Are we able to do any of that? I know Mr. Collier, Mr. Treasur, are we able to take any of those things or know like because you know you have the that may be on the I don't know if that was
something I'll check into that I don't remember talking. >> Okay. And what that would be um I don't know if it's called title 20. I just know that whatever there's a you can apply for it based off of income and it's a um some sort of a stipen that a parent or guardian would get to have daycare services or prek services for their child. Um so I didn't know if that was something we had um because that's a state well federal and responsive state. So you get back with me on that. Okay, that was my question. Thank you. >> One other thing I wanted to bring up. Um I I do think we transport >> pier. >> We do. Okay. >> Is that getting >> Okay. And I know she said she said she wasn't
sure. So she made it clear she didn't. So you're confirming we do. >> Yeah. >> Okay. >> I will add that we have I think I think I see it three or four people here that were at our policy committee. They came to our policy committee meeting, but Ashley couldn't make that either. And so they really want input. And so I would I would like it if we could have a policy committee to go over this when they're present and they can weigh in. We did not do that because she was not there and we didn't have it on the agenda. And so apparently they were patient enough to show up here. Um and um I I mean I don't have fundamentally I don't have problems with this. I I think I also understand that
this $50 we we went way up with it and lost people and then we came back down. Is that right? We've kind of messed with that number. We took it too high maybe lost population and now we brought it back. Do you know the history there? >> Uh it was 50 for a long time. We did some increases sort of stepping toward being similar to other districts around us and then when we saw the $50 in the policy >> Oh, it was the policy that triggered it. Okay, great. Oh, so also um do I don't I think this would be appropriate. Um the morbaturs you guys h any feedback on this is is it have you looked at the policy? Do you think do you have any feedback on this policy at all? Okay. Thank
you. So >> my my ask would just be that we allow the people that came to our policy committee meeting a chance to weigh in and uh make recommendations of the changes. So, I' I'd like to see us just take this through the policy committee um or otherwise introduce a method uh that they can redline or make their suggested changes. I think that would be fair to because they're the they're where the rubber meets the road and I'm sure they know more about what will make this work than we do sitting up here. So, >> I think that came up last time and I thought Miss Zimmer did not. I didn't think I don't remember her. So, I don't want to say I I'm not saying we should not hear from her. Um, if that
was already on the policy committee meeting and Miss Zimmer wasn't able to make it or was it does she know I'm not being funny, but I wanted to make sure she was notified and knew to be there or was it that she just really didn't make it cuz I thought in the last meeting that we postponed um it was going to be the second read. She had already done the research. She wasn't asking for it to go through the policy committee. But I could be wrong without pulling up meeting minute notes, but if that's the >> Yeah, we did at the last I think it was the last meeting we did make a motion to send it to the policy committee and that did not pass. So, um I think we are ready to vote
though if there's no more presidential comment on this policy. >> Um I forgot that. I forgot that that didn't pass. Maybe maybe we should revisit that because I do think it's fair. And I will say, I know from talking to Ashton, I don't think she'll mind me saying that. I think I think she got some help primarily from outside our district for writing some of this and um there is definitely opportunity uh to include include more people internally in the decision making process. So, um I motion after we take a vote to take it to the policy committee. >> So, I didn't hear I didn't hear your motion. I'm sorry. Yeah, we we're voting on the motion to um second read. Could you take roll call, please? >> Okay. Um well, I need a >>
I don't think we did a first and second yet for the motion. >> Motion for the second reading. >> Okay. Could you repeat the motion? Motion is to appre approve the the board recommends the growing board of education approve IGCG second read >> I will make a motion just to postpone until the next meeting when Ashley's here. Do you want to make a motion to table? >> I had to postpone until the next meeting when Ashley's here is what I stated. >> So, we will cancel that motion. There was no second. So, that wasn't good. >> The table um the second read of IGCR. >> Yep. And that was me. So, if we could postpone to the next um board meeting. Okay. >> Y Thank you. >> So, the motion is now is to postpone
it to the next board meeting. Yes, please. Oh, you want to postpone to the March May? >> Sorry, the May 12th board meeting. >> I need a first and second. >> I'm the first. Sorry. >> I need a second. >> The second. So my comment would be I think if we do that I guess I would want to know how in the in the one week's time we get feedback from the four people in the room that are here from the well I shouldn't say more five six seven how from the people that are here and uh from the the the uh the academy there and how how we would get feedback from them in a week's time and make the changes I think would be better to postpone it uh and then refer it
uh to either the policy committee or board committee of the whole uh to allow review with the employees so they can have input my my desire. I just want to put that in there. Thank you. >> Yeah. And then I will also add you know whilst you had questions um and uh you made your statement today do you have any suggestions on what you want changed? If you could provide that by the next meeting, I think that would be helpful for all of us so we could come to a consensus in those areas. If you have suggestions on those changes, that would be great. >> No, I don't have a response to that. I don't have that right here. No, but I would amend. So, do you want to amend the motion to postpone? So,
>> I don't I do not. I'm just asking >> We can vote on We can vote on that. Thank you. >> Okay. I was just asking that since we're on that motion that if you could through all your questions you had I'm asking if you could provide us your suggestions based off the way your questions were written. I was just wondering if you had any suggested changes. >> Well, right now we have a motion to table so we need to do we have a second Adam? >> We do but it was we can discuss why >> I think I'm sorry. Who were you directing the question at? >> I was talking to Kathy. Oh, >> because I was just saying since we're postponing and what you were talking about coming back, John, and about making
sure, you know, we incorporate everyone. I was asking based off of what I read from Kathy's questions to Ashley just now um on this topic that if she had any um suggestions because the way that the questions were written, I was wondering if she had qu suggestions based off of the way she wrote those questions. That's all. No, I don't have any. >> No, I do not have a response for that. Do we have a person? >> You don't or you won't? >> I said no, I don't. >> Will you I'm talking about for the 12th is what I was asking, Miss Kathy. Will you have suggestions by then or you just will not have any? >> I I don't know if I can get questions together by that time. You want me to have
more? I don't want to be directed to do something that I'm not prepared or ready to do. My what I want is I would move that we propose that the proposed IGCGR regulation I would like to vote on the motion. I I'm just you know we have a motion to table. >> We have a second and I can have a discussion. >> I can have a discussion. So I I'm going restate my question for the record so it's clear the way that the questions that you wrote um to Miss Ashley. I read them aloud on record for everyone. So, I was just asking you as we're talking about postponing till next our next meeting, will you or can will you have any suggestions because the way that your questions were written is the only reason
why I asked. >> So then you took it as I was not trying to direct you in any way. I was just simply asking you if you had any suggestions and you said I don't and then I said will you? Is it I don't or I will not. >> Okay. Thank you for that. And again, I will say no. I'm not prepared to have questions or changes or anything prepared by May 12th. Gotcha. >> Okay. >> If you could do roll call, please. >> So, what's the I just make sure I got the motion. >> You table this to postpone until May 12th, sir. >> Okay. >> Or postpone. Sorry. >> Postpone postpone this to an export meeting. I got a first toy second. >> That's correct. >> Correct. I will my last my last
statement here is um I promise is one of my concerns is that we're forming policy uh and and our policy is to in engage the employees in policy decision- making and engage the public. If we just say we're doing this again in a week, I uh then the only way I can see us engaging the select flu few that we communicate with would be outside of Sunshine. And I would rather we engage them in a meeting that is public that is published that people can come to and make comment. So I I'm concerned if we just kick this down one week, we won't have time to coordinate that meeting. Uh well, and I don't know Ashley's availability. So I I would suggest that we maybe not put a hard stop on the date, but simply
identify uh a way a means to openly engage the employees that are affected by this. Thank you. >> Okay. So hopefully >> Okay. So motion again is to postpone to the next board meeting. >> Um Mrs. >> Hi. >> Miss Herbert. >> Hi. >> Miss Walsh. >> No. >> And Mr. Kersner. No. >> So >> I move that we I I move that we postpone this meeting until after such time that we can either have a committee meeting of the whole or a board policy committee meeting uh that involves the affected employees and receive input from staff in the community. Thank you. >> So can I amend that because I'd like to make a motion and you interrupted me while I was getting ready to make a motion for the second time. Yes. So I
would like to amend your motion to be um that we refer that IGCG hyphen R regulation be referred to the policy committee for further review and consultation with the superintendent and the treasurer with input from the preschool program leaders and staff and brought back to the board with a recommended revision with particular attention to ensure consistency with board policy CHA and maintaining appropriate operational details for board oversight. >> Can I amend your motion to >> motion? You requesting the motion to be made? >> Yeah, that motion. >> John's motion wasn't second. >> Okay. So, John's motion wasn't second. So your motion I have that and your first you first we have a second for Kathy's motion. >> Yeah I move that that first second that anybody >> I will second >> does anyone want to
read this? >> No I just want to state that we had a motion similar to this the last meeting. So um and we voted on something similar before. >> Anybody else have any discussion about that motion? Yeah, I would simply say I I appreciate what you're saying. Um, but at the last policy meeting, uh, the employees showed up and and expressed interest. So, that kind of refreshed that need for me. >> I I I would say when we revise the policy, we have policy. That's it's how we've revised the policy and engaging the uh community staff members, superintendent and treasurer of course being part of that process. Um and we have a policy committee that I don't understand why any of my fellow board members would not want our um uh program leadership or the
community to have input in a policy that affects so many of them. I would like to answer that. >> Thank you. Yes. >> Yeah. So, one, it's not that um we don't want any input. I'll speak for me from anyone. That's never been the case. Um I think a lot of times we allow pride to get in our way. And if it's not our idea, then we want to uh put it a certain way. That's just you asked. And then as far as working with the policy committee and how it was how it's been running, the time frames, the times that um the one that we did have in the very beginning, um the notices, uh the time of the day that is selected, I don't personally for me like that. Um it is it
is a challenge. I don't feel it meets the needs of all constituents to be there and available. They've been at 4:30 during the day. So, we've got educators that may not if they want to come come. And maybe this last one, it wasn't like that. Um, we don't have a set schedule for that um for the policy committee from my understanding. But I will state that I do think that um I I do believe that wholeheartedly u Miss Zimmer did her due diligence. She did reach out. She it may have not have been in the policy format, but I knowing how she's been on the short time that I've served with her, I'm I'm confident to say that she did have to speak to apparently the superintendent. So, I'm that I'm I would be fair
to say that she's probably reached out to the preschool um to have some of these conversations with staff um as well. So, I'm not saying that that's the case, but in this particular instance, um I believe that Miss Emmer would have done that her due diligence. Thank you. Yeah, I I will just say I will just say um the only thing I want in this policy is for it to function for the students and I don't have any I don't have any dog in this hunt outside of that. I'm not trying to create anything. I'm not trying to make any exceptions. I don't take any exceptions to what's in here. Uh except that I had we had uh a good amount of staff show up for our policy committee meeting. And as I said, it
was based on Ashley's uh schedule and not mine. And uh I'm I probably have greater flexibility than a lot of people here. And um so that's my total motivation. There is no other motivation for me is that employees asked for some input. They showed up to a policy committee meeting where they thought they'd be able to discuss this. Um and just because of everything going on with Ashley, um that did not happen. And I just think there is no other motivation short of just making sure they have a voice and maybe they have some ideas to make this better. Thank you. >> Any other comments? >> I mean they're here. Can I can we ask I would like to know have they been asked like is that I would just like to know since they're
here if that's okay. If they're willing I would love to know what if that's allowed. I don't know if I want to go against anything with the union anything like that. So if it's a no, I can't do any of that. Tap my hand, I'll stand down. But since they are here, they've came twice. >> Order. I'm not following what you're saying. And coming up with some really bad some really weird words. Could you start over again? >> No problem. I was just saying, you know, they've been here twice. The staff have come twice. Um, and I also stated I do not wish to violate any union contract, the master agreement, in any way. But since they are sitting here, they've come to two board meetings at this time in addition to um apparently the
policy committee meeting. So I was just curious if they have talked to the our board member. That's all. But if I can't, I don't want to get in any trouble. >> Yeah. Be um because Ashley couldn't make it, we did not have this on our board. Our board Yeah. Uh because I'm sorry because Ashley could not make it, we did not have this item. We did not cover this item. So they they did we did not discuss it. We explained that she couldn't be there and we did not have a policy discussion on this. Is that what you're asking? >> No, I was just saying in general because technically we had already voted not to go through policy. I was just saying in general when she initially drafted the policy and so that's why I
was looking at the union because I believe you know I want to follow the rules if there's an answer. I just didn't know if they had been consulted or they provided any input or anything like that. But >> I like >> if if I can't ask that that's okay. They're just sitting here. Um our our amazing staff and they've come twice. So I was just >> Thank you. Thank you. I didn't understand your question. >> Yeah, no problem. Thanks, John, for asking for clarity. Um so are we able to ask or are we going to I don't want to get in any trouble, but if we're allowed to and if we're not, then we'll just sunset and keep it moving. asking if they want to speak. >> I don't mind. >> I don't know if
they're prepared to speak. >> I was just wondering if they included, but if they're not, it's okay. No pressure. I just wanted to give an opportunity if they wish to. If they don't, it's okay. But it's okay. If not, no pressure if whoever representative I was just asking. No worries. Thank you, Mr. are some of the best. They are so fabulous. Um, my son was a typical in our preschool program and I can speak very highly of it. They do work that nobody else can do in this district. But one of the things they do not like to do is to stand up in public forum and that's when they become very shy. But otherwise they are super fantastic. Um they um appreciate a seat at the table and that's what they're asking for right
now. They would love to be part of policy committee and further discussions and that's what they had said to Tammy and I. >> Thank you. So, is there any other questions about the the motion to refer to the public speaking? >> So, no, thank you. I apologize. I was not trying to put anyone on slot, but thank you for coming speaking. >> No worries. But thank you. I appreciate it. >> So, first John second, could you do roll call, please? >> All right. We got Kathy first and John second to postpone it till after we meet with staff, the board policy committee and admin. Um, right. Correct. >> Do you want me to give you the motion? >> Yes. I'll put it in afterwards. >> I'll review the motion. Um, I move that the proposed
IGCGR regulation be referred to the policy committee for further review in consultation with the superintendent and treasurer with input from preschool program leaders and staff and brought back to the board with recommendations uh, recommended revisions with particular attention to ensure consistency with board policy. the CHA and maintaining appropriate operational details for board oversight. >> Then first by second I'm gonna add that um if >> yeah if anybody um in the interest of just accommodating everyone on this board and the teachers if at this next board policy committee um if one of you has specific strong interest in sitting in on that I would allow my seat for you to do that. >> Thank you, John. I appreciate the offer. >> Okay. All right. Now, we're ready for real quick. All right. Mrs. Don, >> hi.
>> And Mrs. Herbert. >> Hi, >> M. >> Because I know Ashley would like to actually get that engagement and hear what you guys have to say. >> Mrs. Walsh, >> I >> and Mr. I. Motion passes on to item six. Approve motion to release previously completed employee survey. A motion and this was John asked that this be put on at the last board meeting. All right. So, the motion reads as follows. Um, whereas the district previously conducted an employee survey using public funds and whereas materials generated in the course of a public business may constitute public records under Ohio law. And whereas the board of education values transparency and consistency in governance practices. Now, therefore, be it resolved that the board of education direct the board's legal council to obtain and release the previously
completed employee survey results, including aggregated reports and related materials with appropriate protections of personally identifiable information. Be it further resolved that such release shall occur within a reasonable time frame, not to exceed 14 days. Do >> you have copies of that that members can look at? I make that motion. If I could have a second. >> Did you condense that? Did you condense that that Mr. Kersner from the one that you presented at the board meeting? Not much. I just cleaned it up and made it a little more readable. It's not much significant changes. I think I abbreviated it slightly and it wasn't like a first read or second read. I was just giving the board a heads up that that was um that was coming and that the intent was to ask to uh
release the previous survey. Thank you. So, does anybody have any questions about the previous completed employee survey that Mr. Kushner is asking to be released? >> Who's this is first and second? Who's the first and second on that? >> Yeah, I made a first and second. >> I made the motion. Oh, did you second? >> Second. >> Okay. >> Thank you. >> I don't have questions. Um, I guess I do, but I don't. Um, we voted on this a couple boards back, couple years back, um, if I'm not mistaken. Um, and then there's also other information that speaks to the survey not being, um, or was tampered rather. So, then I have questions now from legal counsel before being able to vote on your resolution to revisit that. So the full board is aware of
that. Um because the previously employee survey the only one I'm aware of would have been the one in what 2022 or 2023 if I'm not mistaken. Is that the one you're speaking of? >> Follow fall follow 23. And I will is I'm glad you brought up the legal aspect. The reason this is being brought back around now is because there's a Supreme Court case uh Ames versus I do not recall the school district. Okay. where this exact um almost exact scenario has been proven to be public record. Uh that particular survey included health and wellness information that the district refused to um refused to uh let out and they lost that at the Supreme Court level. So, we now have a pretty solid court history uh that shows that because the public paid for this
um it belongs to the public and should be um released to the public in my opinion. If there is tainted or tampered information, um I'm sure that that can be addressed in the process or identified. Um I don't think we have visibility to know short of a few emails um that there really is a substantial uh tampering. Uh I I I know that we've seen that there was some inflammatory stuff and then immediately after that we saw uh emails that were looked at and that was that was the impetus for my um uh me being so leerary to use our email system is because in that process employees emails were looked at after uh it was it was uh explained by the company that did the survey that there was inflammatory stuff in it. So
that may be suspect and but re that is why I don't use our email. But the purpose of bringing this back forward is the recent case law I believe shows that this is in fact something that we owe to the public. >> So the time frame for this is 2023. >> Yes. This was done in the fall of 23. And how I became aware was um a different attorney was in our one of our meetings and I asked if before we did a u a review I think of the superintendent that we look at um uh the survey and I only took my seat in January. So I had no idea it had already been done and then I found out after the fact that we had just had one and the documents were provided
to me that gave me the information I just shared and uh I never we never got to look at it or apply it towards um the the review uh which I think typically haven't been on the board before. That is an instrument that we use um when we're doing evaluations. So the intent would be to use it for evaluations. >> So the intent was to use the intent at this point is to be compliant with open meetings act and I again if we're looking at reducing legal fees. Um, I would I would love it if we could move this forward because I think it's going to be requested either here or in another possibly in another venue which would cost possibly more legal fees. Um, I would say that since the taxpayers paid for it,
we have now case law. Um, we should look at it. If it has a flaw, that's definitely going to be made available as part of that record request or as part of getting that survey. That would be something that we would find out and we would have a better understanding of the whole process. I don't remember us voting on it. I'm not saying we didn't, but that would have been a little while ago and I don't recall that. Do you know what date that was, Latoya? >> No, that's why I said I thought we did. So, I didn't have a specific date as I wasn't prepared to um go back to 2023 per se today with it being 2026. Um thought the goal was to move forward as a board and we keep bringing up
things from in the past and I understand um taxpayer dollars. I'm not mitigating or or neglecting any of that. Um, but I do think if anything we should have a discussion and review first because this was already dealt with in 2023 and now here we are in 2026. And I know you guys said cited case law, but I haven't seen exactly what that is. Um, it was mentioned, so I thank you for mentioning and I was trying to catch what you said. You said or something, I believe, John, but if you have that, I would love to read it as well on what you were sharing. But my concern is just, you know, that's 2023, it's 2026. um in addition to what I recall that it was mentioned that it was that it was tampered
that the the the the survey was not accurate. So, but here we are again. I would rather let's figure that part out first before just voting on an allout resolution um to actually make sure if you want to go revisit it again. But that's just my opinion. But I would love to know the case law and what attorney you said you're quite certain that this could get out. So, are you aware someone is someone wanting to um file against us for that or something? >> I'm So, what I'm saying is from my perspective, we used a trick against the public to not release this. In other words, we instructed No, let me finish. We instructed them if they had released their findings, if they had released the files, that would have become public. So, we
told them, "Hey, uh, first of all, I know firsthand that the the the email request went out and and the survey company said,"Are you sure you want to have this Zoom call? This is inflammatory." Something to that effect almost exactly. And then all of a sudden, uh, emails were discovered. And then we instructed the survey company not to release their findings to try to avoid creating any public documents. Um, and I don't think that's right or fair. If we wanted to do that, if if we believe that the survey company allowed tampering, we should never have paid them. We should not have paid them taxpayer money. We've already let that money out of the gate, and now we're we're hiding it from them. So, what I'm I'm not here to threaten the board, but I
I want I do want to see this information because I I think we should know what is in it, and uh I think it's important if it's part of our oversight. And so yeah, if I don't get it here, uh I may I may or someone else may seek other means of getting it. And I I do truly believe that it is due uh through open meetings. And we can debate that and you can look at other things. Um but I also say that we all have the logic and the intelligence to determine if there are a zillion duplicates or there any problems with it. But I think the uh the survey company pretty well stood by their work and that's why we paid them. >> Just a statement that we have so many pressing
issues. I don't think this should be one of our priorities. And then again back to the legal cost. We do this and it's self-inflicted and it cost our kids in our district um a substantial amount of money that could be used for resources. >> So, I'm not sure I understand that you're saying it would cost us money to get the survey that we paid for from the survey company. >> No, I'm saying the threat of litigation due to not getting a survey from 2023 could result in additional legal costs. >> Right. we would only incur legal cost if if we end up fighting over open meetings and or a public records act I should say. So um there's no reason to do that on >> but it sounds like it's spearheaded from you is the
impression I'm under based on your statement >> spearheaded from you. No actually it was not. Okay. No, it was not spearheaded by me. I wasn't even aware of this at all. I was made aware of this by by people in inside our district that felt cheated out of their survey that they took. So, no, I didn't even know about it. It's not I'm spearheading it now because I'm frustrated and now and because the employees felt they didn't have a voice. Their voice was taken away and now um I'm made aware that there's a Supreme Court case that gives them what they believe they deserve. So, that's why I'm speaking. Right. So, I guess you can say I'm spearheading it. I just want to clarify why it's not I never took the survey. I never created
the survey. I don't have any answers in the survey. I just wanted the teachers that took the survey to have a voice. >> So, my take on it is that it's should be very easy to get a survey that we already paid for. It shouldn't be complicated. um the board has a responsibility to provide oversight. So if we paid for it, we should see it and um if there's problems with it, I'm sure those were documented and we could review those documents. Uh we have that ability. This is the cost of getting the survey is nothing. And if there is court um now law there's law that uh the Supreme Court has ruled on something similar and there's a chance that it could cost the district funds. It seems silly not to just get the
survey. I don't see what the big deal is. So that's my comment. Are there any other questions or comments? I I just don't I it seems like we'd be putting the district at or the board at risk of another lawsuit which we don't want to do. So for something that would cost us nothing to get that just seems silly. Okay. If there's no other comments, um Adam, could you do roll call? >> Mrs. Donald, >> no. >> Mrs. Herbert, >> no. >> Mrs. Walsh? >> Yes. Mr. Kursner. >> Yes. >> Thank you for your consideration, fellow board members. >> The next item on the agenda is number seven, approve motion to authorize anonymous employee survey. This was brought by John at the last meeting. He asked this to be on the agenda. >> All right.
did have a copy of that information. >> Yep, I do. I'll pass it down. Um resolution authorizing independent anonymous employee survey. Whereas the board of education is responsible for making informed decisions affecting district operations, financing, and whereas input from employees can assist the board in understanding organizational conditions. Now, therefore, be it resolved that the board of education authorizes the board president in coordination with vice president and administration. uh the GMLEA, a non-certified employee union representative as appropriate to engage an independent professional firm to conduct an anonymous employee survey. The target gates dates for the survey are agreement by June 17, 2026 and for the survey to be conducted in or around the same time frame in July of 2026. Be it further resolved that the SH survey shall preserve respondent anonymity through aggregated reporting be
conducted independently without alteration or suppression of results. Work with the GMLEA and non-certified staff un representatives to establish safeguards against retaliation and protection of anonymity. Include reasonable safeguards against duplicate responses and provide results directly to the board in full. Be it further resolved that the board retains authority over control of the survey in accordance with applicable law. >> So that is my motion. If I could have a second, is there any questions about John? >> Did you make a second? >> I made a second. >> Oh, no one could hear you. I'm sorry. >> Yes. Second. Um my comment is um in my sixth year on the board um the past two are the only times I have seen this district go a year without an employee survey previous my previous time on the board
this was just an annual regularly occurring event and it was just aggregate to how we made our decisions how we judge the employment climate I think it's important I think uh no matter what organization you're running um surveying uh the people that that serve curve is very important. So, I'd just like to see us reestablish this and get it uh get it going again. Thank you. Any other comments? >> No, I just saw you with saw your papers. I thought you were going to say something, so I was waiting on you. >> Um, yeah, I can make a comment. I would say we haven't had a survey since the survey that wasn't released. I think one of our policy actually said the board will do surveys of staff and students. Um I think it's important
we've had a lot going on. We got a lot of people um they have been asking why a survey hasn't been done. At least I hit up saying why don't you guys do surveys of your staff? I thought that's something you do. Well, we haven't for since the last one. So, I think it is important that um we do that >> since we've allowed them to speak. Oh, I'm sorry. >> Oh, go ahead. >> I was going to ask if the if the union again wanted to address this, if you guys would like to make any comment. I know you love it. She want Oh, they're they're they're doing the rock, paper, scissors to see. >> I think that the previous surveys you were thinking of maybe they were done through Panorama. Um, we have
not been surveyed since the 2023 survey. We would be willing to work with you. I think the last survey was a workplace entered survey. >> Yeah, we use den age but panorama I know is one of the most popular with schools. So >> I think when before co maybe when Gary was here we used a lot we did a lot of pan >> we did we did be willing to work with you and >> do you feel it's important? I >> I do. Thank you. >> Any other questions or concerns? >> I just also want to make sure that we still um when we're talking about our employees and being engaged that we still also make sure when they want to speak with us that we're consistent with that as well. So I I'm I'm
down for whatever. But also we also need to be consistent as a board when not just one set of people ask to speak with the board but when all has that we offer that opportunity at this point especially as you stated was getting the climate. Thank you. >> Um I have two questions. One I guess would be for Adam. Do you know the cost associated with this survey? No. And then >> I can tell you the last engaged survey was 7,000. >> Okay. And then the other one is for Jamie. Is there one schedule or plan? >> No, there's not at this time. >> And what was your thought as far as execution? Um would that come back to the board? I know this resolution is just to get it going. So how would that
be determined as far as the pace and scale of that? Would that be a board discussion along with our administration? What does that look like? Because that's not clear in the resolution. So once if this, you know, the resolution moves forward with the um survey, how are we, you know, moving forward? I I would have an idea that we could we could have a um ad hoc onetime committee or we could do a committee of the whole and just meet with them. I think there's several ways we could accomplish this. I really don't have an opinion. I think the teachers will probably have a better idea how to do this than I ever would. So, I don't know. >> Yeah, it look like you had the June 17th date, but that's I was wondering pre-work
in the beginning and how we would all work together and do all those things. So that's why I was just asking and and I think my recommendation is the committee is that we all as a board are involved in that process. >> Yeah, I think I I would hope we can accommodate that and I like I don't really I just want to get the wheels turn and I don't feel the need to be involved in it because this is not my wheelhouse. Um but I just want to get the wheels turning on it and let the people that know what they're doing with the surveys get it get it done. When you say that though, what do you mean? Because the last time from my understanding, um, they they they did use the people to
get the survey going. So, I guess that's why I'm I'm asking and then we had the the issue. So, when you say work with the people, who are the people? >> I'm saying primarily for me it's the teachers union and opers who they like. Yeah. >> So, you're saying union only? We're not going to survey administrators. We're not going to survey everybody. Are you only speaking of union? Um, >> no. I'm saying they would probably have like um they just mentioned the company that is prevalent in education. Okay. I I I I would think the company itself is going to have a lot of input as to what is typical in a survey. I don't expect the board to be I don't for me I don't have a question that I want on that survey.
It's not my place. I'm just trying to get it started. I don't know if that answered your question. I don't have the exact answer for how we get to the date except that we probably should meet soon and we could establish uh we could establish two people to do that. It doesn't matter to me. Whatever you think works as long >> Yeah, I think the full board would be great. That's all I wanted to make sure we talked that out just so it's on record. Thank you. >> Any other questions about um Mr. Kersner's resolution? All right. If you could do a roll call poll, please. >> Mrs. Dberg, >> I. >> Mrs. Herbert, >> I. >> Mrs. Walsh. >> Hi. >> And Mr. >> Hi. Thank you again for your consideration. I'll pass the
copies down. >> Motion passes. And we're on to Item eight, budget reductions. And there's a should be like a revised um budget resolution that was on the desk. Did we get a first and second on this yet? All right, there's no personal second. So that move on to the next item um which would be Treasur's agenda. >> All right. The treasure commens mass school board education approve the attached donation from the girl United Methodist Church. I need a first and second. I move. >> Second. Any questions? >> No, I would just always say thank you for being available um when we do have questions. So I I don't have any. Thank you. When I need you guys to answer, you or Miss Con. Thank you guys. Tanya's great. Yes, she is. I'm still trying to
find it. Hold on. >> There we go. >> And thank you to >> And I'd like to go ahead. >> I just want to thank them for the donation. >> Yeah, that's what I do. Thank uh the Groport United Methodist Church for the generous donation for the color run t-shirts of $200. Um confused I thought the run was sponsored by the Groport Madison uh Groport recreation center but I do appreciate them making that donation. There's multiple donations if I'm not supplies from the schools and stuff. >> And then the edust also did some donations. >> Great. Yeah. Thank them very much. >> I'm I'm just sorry I got lost and confused. I thought we were on approval of the minutes. >> No, she she >> that was moved to active executive session. >> Thank you.
I'm >> sorry, John. I did hear that. >> I did hear him say that. >> So, this is just a donation. Thank you very much. >> Any other questions? >> Thank you. >> Well, we did you do a just administrative question? Did we get a uh thank you cards out um that to all of our donors and all letters and such? >> Yes. >> Okay. Thank you. >> Great suggestion. >> I need to excuse myself for about just a couple minutes. Please continue with your >> Yes, sir. Roll call. >> Yep. >> Miss Oliver. >> Hi. >> Mer. >> Hi. >> Miss Walsh. >> Hi. >> Mr. Hi. >> All right. Now we're on to Oh, real quick, Adam. The next meeting you're going to have a full agenda for reports and stuff. >> Yeah.
My reports because it's the second. There's no way. We just got stuff done yesterday. Okay. >> So, yeah, the financial reports will be on the next. All right. Or next. Yeah. Um, so now we're on to the superintendent's agenda. >> Superintendent recommends that Gport Madison Schools Board of Education approved the attached contracts with HMH Education Company. >> So moved. >> Second. >> So I just want to make sure I understand. Are you um recommending the one year or the three-year? Actually, I'm going to ask Mrs. Morriser to come up. Sorry, kind of the got the neighbors going on, but I believe it was the three. It was a uh cost savings with the three-year. We were able to lock in the cost um so that we don't see an increase in year two or year
three. And I asked the high school staff, this is a um the HMH curriculum at the high school. They've been using it since at least 2023. And I asked the high school department chair and he checked with his team. Um they want to continue using it for those courses. >> And you've been pretty happy with the results of the program. It's a good program. It's a it's a good curriculum. >> Great. Thank you. You're welcome. Any other questions? Do a roll call vote, please. Mrs. Delber, >> I. >> Mrs. >> Yes. >> Miss Walsh. >> I. >> And Miss Gerson, >> abstain. >> The superintendent recommends Growport Madison Schools Board of Education approve the payment in L of transportation reimbursement. Ohio law allows for public school districts to determine the impracticality of transporting resident students
attending schools not located within the district after consideration of number of factors. Upon that determination, the school district is permitted to offer payment alone of transportation to the parent or guardian. The transportation department has completed the studies and residents in the affected areas will be offered payment alone for the 2526 school year. The initial list of families being offered payment of transportation is attached as executive content since it lists the student names. Per 3327.01 of OC we are declaring students listed below impractical for one of the six reasons. I move >> second. So, uh, when this came up before, there was a question, um, about the dates in these, and actually, um, I was at the time thinking this was for next year. These were names that were inadvertently left off of previous board agendas
for this year. And before we can process payments to the families, we have to actually approve the payment of those. So, this is a a catchup of something we missed earlier this year. Um, I have a question, Mr. Treasurer. Um, do you have an idea what the average reimbursement amount is? >> No, but I can get that for you. I still want to say number. >> Do we do most of them usually fall over the threshold where we have to issue 1099s? >> I think the answer to that is yes. Let's let me get the exact answer. know the email the whole board exactly what the amount is >> but we do we do end up issuing 1099 to some of them correct >> yeah if it's over threshold >> thank you >> uh thanks
for the clarification on the year I appreciate that uh if there you said there was a cut off date that families have if they want to if they're going to a school were you able to check on that date you said you thought it might be April but you weren't sure >> well Um, what I was thinking the last time when we met that this was for next year and charter non-public schools are required to get us their schedule, their start dates, their hours by April one of the spring before, which is a true fact, but it doesn't have any relevance in in this particular situation. The other thing that changed a couple years ago, we used to do payment and L only maybe like once or twice a year and the the new law
that's in place says that um when someone is uh deemed the transportation is deemed impractical and they're uh up for payment L you have to put that on the next regular board meeting. So for some of you, well, for everybody now, when you used to have it only a couple times a year, now we typically have it might only be one or two, we have virtually every meeting that we we bring them forward. Uh so that's that's part of the reason it's it's on every meeting as well. Did did we potentially jeopardize our their response time by by retroactively doing this because they have a appeal window? Is that correct? Um, I don't think so. I can check on that. Um, yes, there is an appeal time and and a window. Um, I'll I'll have
to follow up on that. Okay. Thank you. >> Thank you. Any other questions? Roll call, please. >> The first John and the second by the Toyota. Mrs. Dberger. >> Hi. >> Mrs. Herbert. >> Mrs. Walsh. >> Hi. >> And Mr. Perfect. >> Hi. I app I appreciate you calling me Mr. Perfect. That's what Google says. That's what Google says. The superintendent recommends Growport Medicine Schools Board of Education approve the contract renewal with Frontline. >> So moved. Second. >> Any questions about this contract? >> So, we've been How long have we been using front line? >> For a while now for like absence management, ASA and now we're using it for LPDC and other stuff. We're using front line. >> So, yes. um in addition to absence management I think it was a couple of years
ago we switched over the HR and recruiting functionality as well and with uh the mandatory switch we had to do with LPDC uh because our former provider couldn't support the software anymore this was the district's choice to move forward with this as our as our mechanism to to do tracking the professional development plans >> it also did the payroll something too. If I'm not mistaken, there was something that was an issue with something that was in your office in HR and it didn't it would now sync. It syncs that if I'm sink USPS did >> okay thank you. >> Thank you Mrs. Mrs. Diver. >> I miss her. >> Yes. >> Miss Washington. >> Hi. >> And Mr. K. >> Hi. Superintendent recommends Gport Madison Schools Board of Education approve the attached one-year common rent
quote. I move >> second. >> Um Carol, I'm sorry to do this. >> The next few items are with you so you don't have to run back and forth. We can get your chair up there. Yeah, this is a one-year um we currently do not have a curriculum in the middle school. Um for the for last or this current year, our teachers are piloting common lit. Um the idea we're talking about consistency with them and we are we implemented CKLA K through five. This is year two. So something for consistency at the middle school as well. Um we discussed with them the possibility of moving to a larger curriculum but they wanted instead of doing that doing common lit for um one more year. It gives them a little bit more flexibility to kind of
keep doing some of the things that they like to do but still getting them in alignment for common assessments and having common conversations. So going with one more year and it is um more financially sound. >> Thank you. I have John's first and Kathy second. >> Mrs. Zberger. >> Hi. >> Miss Herbert. >> Yes. >> Mr. Washington. >> Hi. >> And Mr. Her. >> Hi. >> Superintendent recommends Gport Madison Schools Board of Education approve the attached high school credit recovery summer school coordinator and teacher job descriptions. So move. Second. >> I have a question um for Carol. Um I think you've made some headway in um getting I think this might tie into this. I hope you've made some headway in getting students to better participate in courses that they might otherwise ignore and wait
for an easy way out in summer school. Does this help with that? And can you tell us about that? I think one of the big things and I'm looking at Tammy for this. One of the big things that we've looked at for to help with summer school is one of two of the courses um algebra 1 and ELA for this the courses that have the state test that are attached to it. Instead of just allowing the students to take it in summer school, let's have them actually retake the course so that they really have a year of information, learning that information so that set sets them up to be more successful in their courses later on as opposed to just taking it in summer school and then possibly, I'll be honest, I've never seen anyone
take algebra one in summer school and then go on and be successful in in a future math course. So, we put that in place a few years ago. I think um Mrs. Roage can and speak to that as far as ELA is the same way. Having those students take those courses again with our teachers who are the experts um as opposed to doing it online. And they do have teachers there to help them, but hearing it from a teacher versus just learning it online is is totally different. So, I think that in the long run is going to help those summer school numbers as well. We're still we just put it into place a few years ago, so we're not there yet. And and I as I understand it from the student perspective, they knew
that they had that out. So they might actually not even try >> 100% >> try to take pass the course and just said why I can sit here and make >> and get the same credit and doing summer school. So we we started that with um algebra 1 and ELA uh 10 10th grade English which is ELA 2. the reason for that. Those are the two courses where students have to earn competency on their state test in order to then be able to to graduate. So, those are the courses that we focused on. >> Thank you. Thank you very much. >> You're welcome. >> Um you'll also see that this is um a scaledback version of summer school. This is a high school only summer school. We're not doing um middle and and elementary summer
school programs. We had outsourced those for lack of a better term. Um we had varying levels of success with different programs. We still even though there was some improvement, there was some struggle with participation numbers and it was pretty expensive. So we made the determination as a cost-saving measure, we're only doing the high school credit recovery this summer. A lot a lot of our neighboring districts have s facing these budget situations have scaled back or totally eliminated summer school offerings. >> So then a student that would typically be referred to summer school in the lower grade levels are they repeating or is it just different according to where they're at? >> In the past the summer school wasn't even based on whether it's just whoever wanted to sign up for it. wasn't necessarily um if
they were you you go to summer school or you fail or you repeat a course. It wasn't it wasn't that it was families who signed up for it. So in many cases um it was a a babysitting situation. In some cases parents would sign up um truly wanting you know truly wanting academic academics to t take place but it wasn't based on that. Um before years ago, uh before they the state changed the third grade guarantee, you had to do at least I believe it was 10 days of tutoring in order to be able to take that the third grade test again to be promoted. But when the third grade guarantee changed, that um that provision went away. That is no longer required. >> Okay. So way back in the day, it used to be
you came to the end of the year and you didn't quite cut it for credits or grades. you went to summer school so you could move forward. But that's >> right. And the what we've offered in the in at least the few years that I've been here has just been for academic assistance. Um it hasn't been if you come to this you're able to be promoted. It it it's just been academic assistance. >> Thank you very much. >> You're welcome. >> Mrs. Dber. I >> Mrs. Herbert. >> Yes. >> Mrs. Walsh. >> Hi. >> And Mr. Gerson. >> Hi. >> Superintendent recommends the Gport Madison Schools Board of Education approve the attached quote and payment structure with ampl amplify. >> So move. >> Second. >> All right. This is a pretty big contract with a
lot of different layers and I'm gonna defer to Carol on this. >> Okay, this is with the same company um that we use. Amplify is the same company that we use for CKLA uh which is our ELA uh K through five curriculum. We just are finishing the second year with them. Next year will be the the last year of the payments, the five-year contract. So third year for ELA going into next year. Then we would be starting the first year with math. Um to kind of tell you how this came about, we've been piloting Amplify Desmos math all this year. Last year, so it's been a two-year process of a team of teachers, administrators, um sitting down and looking at different options. So last year we let teachers decide how what they wanted to teach
as a grade level in you know at uh Growport Elementary and third grade. What did those teachers decide to teach? Either uh Desmos and this is what the the teachers had decided they were going to pilot Desmos or continue with I Ready. And we had a pretty much a pretty even split K through eight. Um because we do know the state it is coming that we will most likely have to have high there's going to be a high quality instructional materials list. We have that for elementary uh ELA right now. We suspect that that's coming down the road for for math as well. We do know it came out not too long ago a K3 assessment approved assessment list. The elementary had kind of decided it was going to be between Desmos and I Ready.
the I Ready assessments that you're familiar with that you're you've heard our students talk about in K3 is not on the approved list. So that kind of made the decision for us between I Ready and Amplify Desmos. Um it doesn't make sense to go with one curriculum when their assessments aren't approved. Maybe they're approved down the road, but right now we we can't wait on that. um our teachers need to know before they leave for the summer what program they're going to be using next year. So that decision was kind of the the teachers in the elementary. We met with them and it was January or February. We met with the team. They said they didn't want us to bring in other companies. It was one or the other. The state decided I Ready is
not an approved assessment for K3. We're going to So the option is to amplify Desmos. When we get to middle school they wanted to review a little bit more. We brought in three other companies. We reviewed. We narrowed it down because I Ready wasn't on the list for elementary. We can kind of see the route that the state is going. And so we were looking at three. When the teaching and learning team sat down with Mr. Smathers, Mr. Grub, and Mr. Collier, we kind of looked at it from the full financial perspective. Um, this is going to allow consistency K8. It will allow consistent PD. It will allow for the treasures department um because it's the same company. Next year will be the last year and correct me if I'm wrong on this Adam. Next
year will be the last year with CKLA and Amplify has agreed for our first year of payment for math for it to be the cheapest year. So because we're using the same company, uh Mr. CER was able to work with them on working on a payment plan that will work for the district as well. >> Correct. And so and we look at also what we're spending now over the next five years and and it was really close. I think it was like a reduction or savings of like $15,000. So that's why I was comfortable with it. >> Are you comfortable standing this long? >> I'm okay. Yeah, I'm fine. Thank you though. Thank you for explaining. >> You're welcome. >> All right. Mrs. Dber. >> Hi. >> Mrs. Herbert. >> Yes. >> Mrs. Walsh. >>
Hi. >> And Mr. K. >> Hi. The superintendent recommends Gilport Madison Schools Board of Education approve the contract with writed school as attached. >> So moved. >> Second. >> Okay. Um I um put this in my board update last week with some information. Um Mrs. Walsh emailed some questions and I gave you a barrage of information today about right at school. But the short version is um right at school is before an afterchool program. Um right now we offer EDP and this would have that become an outsourced program and there are some benefits to that. Uh, one of which is um because they are eligible to be able to give um different types of pricing options or or get reimbursement from the state for students who are free and reduced. We think that the program
is going to be able to serve a lot more kids for families who might not have been able to afford it before. So, our hope is that this would expand from the two schools we have now to all six elementary schools. Um, even though this would be outsourced, one of the things they would look to do is want to talk to our existing staff members who want to continue on. But again, in the in the information that I gave you, there's a lot of overview. There's some case studies I I sent you. One was with Beaver Creek, one was with Springfield. Um, and so I guess I'd entertain any questions that you have. >> Um, what do you project this cost difference, savings, etc.? >> Actually, we'll we'll lose a little bit of money on
this because the ED program we run now, we bring in a a profit and we'll still make a profit. It's 3% of our sales, but we will will lose probably 45,000 a year on this. But again, it I'm okay with that because it serves the six schools and hopefully more students. But again, and that could change. We could get more money from them, but we are going to lose a little bit of money on this. So, are you saying we'll lose money by expanding to the schools or with the exact model we have today, duplicating that model, we will lose the 45 >> with with it being contracted out, we'll lose about 45,000 a year. >> And are you saying we can't do the model ourselves to expand all the schools or this model somehow
would then begin to save money as it expanded all the schools? Please explain that one if you can. John, I couldn't hear the question. I'm sorry. >> Okay. Uh I'm so I was trying to ask the treasurer, but maybe I'm asking the wrong person. So, in its current model, outsourcing this to the schools that we have today will cost an additional roughly 45,000. You mentioned that using this company will hopefully allow us to expand from two schools, two schools to all the schools, right? So if the if the model were all the schools, what would the price differentiation be between outsourcing and in-house and what would be the reason that we can't expand using our in-house resources? >> All right, I'm going to do my best to answer that and then I'm going to ask
another person to come up. My my best reason to do that, our revenue stream right now comes from payments from parents. Um, if if this is outsourced with students to the other buildings, there are students and and I I don't know if I want to say that it would be free or reduced. I don't know that. But I'm going to bring up we have someone here from right at school here tonight. She has the greatest name ever. Her name is Summer Beach. >> Summer Beach. Summer, you want to come up and talk about a little bit about how the the scaling works? >> Yeah, sure. Yes. As Jamie said, I'm Summer Beach. it is my real name. Um I appreciate you having me here. Um so the scaling what the 3% revenue share that is
our estimate based on your current enrollment in your two sites. So we expect as mark as our marketing team uh gets the message out there to all the families um we expect that the enrollment will go up because it's going to be at six sites. And so we believe that 3% will equal more money. And then as far as the subsidies, what you're talking about, because we're a licensed child care provider, we do accept subsidies and we're a we not only accept them, but we help families through the process of applying as well. And then they're able to use whatever rate they are given as their tuition for right at school, which sometimes can be as low as $10 or $15 depending on the subsidy. So, so if I'm if I am a needy parent
and I go through the process and I get the $10, $15, $20 rate, um, that doesn't affect your cost to the district. Correct. >> Correct. We're still reimbursed by the I I'm saying government, state, I don't know if that's the right word. So, um, a standard student coming through, um, our current cost model is X per student and it's going to be Y per student, right? With, let's just say, switching over to you, it's a little bit higher per student. Um, what I don't understand then is we're introducing subsidies through the state. So, question number one, are we as a district not able to get those because we're not a day because we're not a daycare, right? And we never have been. Correct. Okay. So then once we introduce that, we're actually absorbing more cost
because we're paying the difference or not? >> No, it's just that our revenue from them again it's the worst case scenario hopefully is we're losing 45,000. Hopefully it won't be as much. But the worst case scenario is hopefully 45,000 but hopefully if our numbers increase and we won't lose as much but with this benefit right now is I think Carol can I think one kid right now is like $3,100 for AM and PM. So if it's $3,100 but they can get a subsidy and it cost a family 10 or 15 that's really going to benefit the family. So we're going to eat a little bit but we're hoping with going from two schools to six schools even though I don't like losing money it's going to be beneficial for the kids and hopefully we can.
So maybe I'm catching on to something new. You're saying even if we expand and you're from your estimates even if we expand to all six schools you don't believe this will this initiative will cost us more than 45,000 a year worst case of that. Correct. >> Yeah. And actually we right at school is uh costneutral to the district. So it's parent paid and um so the parents are paying tuition and then we're able to get back. >> So John, in this case we'll have no expenses. We'll just get a revenue check from them. >> Okay. >> You see what I'm >> But the revenue check will be at worst case 45,000 less than if the parents were paying us direct. Correct. >> We're able to expand services. >> Correct. >> Thank you. I do have
a question. Since we don't have the accreditation as a child care facility, what is the reason why we didn't consider that route by chance or is there barriers on becoming accredited or child care facility to then obtain that so we can get the subsidized dollars? Have we never looked into it? Just curious. Just throwing it out there. Sorry though, monkey rich and everything, but >> I I mean, honestly, I think the answer is we're not a child care business. This is something we tried to do to provide support for the parents, but >> I don't know the answer to that. I was just asking and my thought was the only reason why I asked that because I'm thinking our um looking at our demographics, looking at the economics, this may be the one time maybe
we want to consider that scenario as well in addition to what we're already doing because it may benefit based off of the um median income in our area and the the zip codes in which we service. That's what I ask. I just know as long as I've been here and I I think in the history of EDP it never has been. >> And then with the EDP staff, um any any information you can share on that? >> Some radio help to >> Yeah. So part of our transition um we're we're locally inspired and so we want to bring we want to be a true partner and be an extension of the Growport Madison community. Um and so and part of that is who knows your kids best like the parents and adults in your community
um that may even have children in in the school system. Um and so they are sorry my brain just stopped working. It happens. >> The current staff >> Yes. So we are able to um we actually meet onetoone with each of the staff members if they're interested in pursuing employment with right at school and as uh right at school employee and a Groveport Madison employee they actually get 100% of their tuition covered if they have children in the program. >> Okay. And do they get first uh right uh like preference as far as employment first? Like we're considering our staff first ma'am before going outside. >> Yes ma'am. Does this program expand the apes group at all or is it the same model? >> Uh we are planning on taking over the same model. So
it would be K through five >> but at six sites as opposed to two, >> right? Do you have models in other schools where you actually go to lower ages? >> I'm sorry, can you repeat that? >> Do you have models in other schools where you go below that age? >> Yes, we do. also offer a prek extension program as well as an option or an add-on um if if that's necessary. But yeah, we do have prek as well. >> Thank you. >> Um Jamie, I have a question for you. So I did go on a visit to see like after school program and one of the major concerns was space. So with the expansion, where's the space coming from? Well, um that's something that's always a premium for us when we have different youth
programs and and other afterchool programs. Um I I guess I would say and this is uh speculation that I'll I'll defer to summer a little bit but you know right now uh one of one of the first things we started when we meeting with right at school they wanted to see our numbers and what's the participation and so if I'm remembering correctly it's about 70 >> yes >> 70 students um and so I don't know how we divide 70 students into two buildings but I'm guessing that's either or a big area or multiple rooms whereas um you know what could it grow to? I mean, it could potentially grow a lot where space is a real issue, but it's also if we have a if we're able to have a program in each one of
our buildings, I would think at least initially it would be smaller and easier to, you know, figure out uh in a smaller space than but one of the things in in there that um we asked right at school and they confirmed um that school needs for space utilization always take priority and work what we work together with them in the building to figure out how to do that. Um, and and there's other uh there's other implications also with cleaning schedules when you have lots of after school activities. When can the custodians get into the rooms to clean and sanitize and and and do that? But that's just something we'd have to work together. That would be something if we were able to internally expand, we would have to contend with as well. Uh, and and
again, no one ever likes to have a drop in in revenue, but I'm also excited about the ability to potentially serve more of our families. Um, and if we're able to have programs in each one of our buildings, that's going to eliminate the need where we're putting a kid on a bus to drive them from one building to another building. And so then they're missing the beginning and then they're waiting for their so we would have at every site which would be beneficial as well. I'm sorry to kind of give you an idea. Now, what we're doing is they use the gym and cafeter gym cafeteria. Um because of the the numbers that are allowed, we can only have 36 students at a time because we have two people working. So, it's one to it's
a 1 to 18 ratio. So, they fit in the gym, two adults. U and we have my current numbers that we wrote down a couple weeks ago. Glen Denning in the we had 30 in the morning, 23 in the afternoon. Sidelia was 34 in the morning, 25 in the afternoon. So, they are able to fit in the gym. Um, to give your I think it was John that asked about the cost or I'm not sure maybe Adam you mentioned it. One student if they're going both AM and PM costs 31.50 for the year. So, it's pretty high for a family. Um, if they're sending two ch that's one child. If they bring a second child, they get a discount and that's 28.98. So that that's that's pretty high for a family. Um sometimes when the
family sees that cost they then they you know decide not to not to take advantage of it. >> So um one followup now. So how do you use the gym and not interfere with the gym? Are you using the stage areas or how do you how do you h how do you have morning and afternoon in the gym and still have gym or swap? >> They're they are done and cleaned up by the time that the student as the students are entering the building EDP enter or finishes and they head off to class and then in the afternoon it's after school. >> Thank you. >> Yeah, I know. I've used EDP so it was great. Um the only other question I had do we did we get an idea of cost savings with the busing
then? So with the the students we have how many students are we busing? So there could be savings because of the bus thing. >> If I remember busing was kind they kind of threw CVS kind of threw the bus in there. So I'm assuming there is some savings. >> Under our current contract there's no additional cost for that. >> If we had to pay for the busing part of this, we wouldn't make any money on DDP. >> Gotcha. So because we don't have it, we don't have the expense. So therefore, there's not necessarily a savings at this time. But in the future that could change with busing then if bus but all a sudden they do start turning busing then we wouldn't make any money at all. Right. >> How many EDP um EDP staff
do we have? >> Four. >> We have a total of five. So we have two at Sadelia. Um they do AM and PM. We have one at Glen Dunning that does AM and PM. One that does morning only. One that does afternoon only. So it's a total of five. And then they're also just member they're also employees of the district too or some of them are only EDP. >> Some of them are only EDP. >> Okay. >> Yeah. >> Two are only EDP. >> That program has been managed out of Carol's office uh with Hillary Phillips who is >> okay. And the only reason why I asked that because then that changes um benefits and things a little bit for those employees when we switch over to contract. I would assume they got some sort
of benefit and I know HR is there but didn't know what their benefits and things like that with changing from leaving Groport. >> No, that would just be like a second job. So like their benefits wouldn't >> I'm talking about those that are only employed by us like they're not they're only EDP like they don't have another position within the district. Correct. How so that would impact them benefits >> and right now they go through the ESC if I remember they're paid through the ESC anyway. That's what I wanted to make sure wasn't impacting like retirement things, you know, things like that. Just asking. Thank you. >> So, yeah, I have some questions and Jenny knows I do. They're more about the contract because I think it sounds like a great program and your literature
about this group was um you know, good and I support expanding an affordable program before and afterare, but I do have questions about the contract. Um that concerned me. So was this contract uh vetted through legal counsel? >> It was. Yes. >> And which who was that that vetted that >> Dane Gashian with Bricker? >> Um so >> you say Bricker. Thank you. So, um, there's no clear right of removal in the CL in the contract at all. So, that kind of concerned me like if we have an employee of theirs that is causing a problem with our students or we find out. Um, I think that might be a problem that we don't have a clear right of refusal or removal of the employees and that's in schedule 89. And >> could you repeat
that last part? >> That's schedule a section. So the other was and I didn't get responses to these and Jamie might not have had time to do it. >> No, I I sent you like a 10page response. That's all. That's all I've done for the last day and a half was responses together. >> I didn't see that. Oh, that's with all the other >> Yeah, >> I didn't see all the responses to the questions. I apologize. Um, >> so >> yeah, you got detailed. So with your question, we gave detailed response for each one and then we also asked for right at school to confirm what we were doing. So all all of your questions have already been >> Well, we can just go over real quick right now. So, um, I want to make
sure that we're are following the requirements of Ohio Senate Bill 29, but I'm sure that must have been covered, right? Because I didn't see an ownership explicit provision addressing data ownership, which I believe that bill said 25 24 is a new bill. Um, so I want to make sure that's in there. And another thing that I didn't see that concerned me was if we have students in this program who have IEPs or 504 who and they require 101 um aids who would be responsible for the cost of those aids. >> Um if a child needs a one to one we are unable to provide it as right at school. So that would be up to the district to provide. So, that could be another additional cost that's not factored in, I would assume. Um, I
didn't see a a defined timeline for notifying the district of incidents for safety, discipline, and incident reports. And I want to make sure that our policies are followed within um our schools. So is there any additional was there any discussion about establishing consistent criterias of documenting and reporting behavior incidents or discipline actions to ensure alignment? Yes. >> Yes ma'am. >> Perfect. Um including PBIS. >> Oh great. That's that was also one of my questions. So I that's pretty important to us on this. Um so one thing that is a problem possibly is that we have um policy of community use of our facilities and I want to make sure that we're not cutting people out who are already going to be possibly using our facilities according to those policies. >> Right. But in in this
case, like we have we've had other afterchool programs with different groups before. Um if it's at our request, it's not just an outside group coming in to use it. They're acting on on our behalf as a resource for the district. >> Yeah. So, one of the things that I was thinking of is like the summer camp. So, because this explicitly says it can operate summer camps, but we're going to have um we're loading our property to grow for the Fourth of July. and if there's any other events like that that we would do if um we'd be able to work that in and being mindful of our commitment there. >> Yeah. Um our first uh this year we're just doing before and after school care. That's what we talked about with the superintendent. Um, we
do offer summer camps, but our operations team always works in partnership with the district to ensure that the appropriate spaces and times align with everything else that's going on. >> Great. Thank you. Um, so I want to make sure about the cost alignment of our facilities because it says it's a 3% afterchool parent paid revenue, right? So we get revenue from that. But this contract also includes um the possibility of um particular programs beyond those like summer camps and non-school day programming. So that 3% doesn't extend to the summer camps and to the non-school day activities. So the district would be absorbing the entire cost. Uh yeah, that's it's um under schedule D and under the cost alignment uh would have been for let's see >> no I think we wouldn't be absorbing any of
the cost. I mean if there's additional revenue coming to them I'm assuming we would get the additional revenue. Yes. So we would have no more cost though. >> So we don't have a if we open a school for summer program we don't have a cost associated with that. That would be the 3% revenue share again. We would just make more money. >> But our contract is not stating that. >> No, because right now they just want to do the before and after school like she just said they just want to do the A and the PM right now. They don't want to do anything else right now. >> But our contract says permittable usage can be a day program in school summer camps and they're collected the program. Um but only 3% is only for
the and that's what the contract says. I'm not, you know, I'm just reading what's on the contract. So, the contract says that we will pay that we will receive 3% of the profit from the um after school program, not for the other programs. So, maybe that's something that was missed. >> I can check it. Um but I just know that the agreement should be for before and after school for 3% for the first year and then that can obviously go up uh with the amount of um enrollments under financial review and fiscal schedule C. Um, looks like maybe six. Oh, here it is. Section four of schedule fee provider to pay the district a sum of 30% of the district after school program parent revenues. It's only for after school. So, that's why I was
concerned it doesn't include summer and that, you know. work things out after the fact. The contract should be accurate when we approve it. That's schedule C section 4 4.1 and then the use for the facilities is schedule D 5.1 the permissible uses which includes teacher insurance stays um programing summer camps >> well for this first year sorry >> for the for the first year we've only agreed to before and after school. We said we wanted to start with um modeling our current program and expanding offerings. Uh and this is a one-year contract that is renewable each year. If we were going to expand to do additional programming, uh we could certainly talk about that to make sure that the revenue share would be a part of uh expanded programming as well. Well, I think that
might have been an intent while you were talking to them, but the contract clearly has does not say that. Does not say that. >> What can you repeat that section you're on, Kathy? Really quick. Oh, the contract where you're saying it's not stating that. >> I'm sorry. You said other contract. Could you repeat? >> I was asking you to repeat the section of the contract that you were mentioning. >> Section schedule C 4.1. >> Thank you, ma'am. schedule C >> and then schedule D is five uh 1.5.2. Another thing that I noticed in this contract is that oops sorry um the agreement allows programs to close right if there's not 15 students and a relatively short amount of notice. So is there any consideration though of doing instead of um to doing like a districtwide
to support our smaller schools that are larger schools like Sidelia support our smaller schools like Asbury and Dunlow. So if we have say 11 kids at Asbury but we have 30 kids at Sidelia that they would be part of that 15 student ratio. Right? Do you understand what I'm saying? >> They should I'm sorry. I just wanted to answer. Um they they uh will do the 15 as an average across the entire district. So they won't just look at the one one building. I don't think that's what the contract says. I mean, that may be the intent, but that's not what the contract says. No, the contract says schedule B, the last paragraph, the programs will run at the following schools pending a minimum full-time enrollment of 15 students per school. The provider shall not
be obligated to operate a program at any site that does not meet the minimum requirement. So, it's not an average. I That's what I'm asking. Can it be an average? Could that language be in there? Because I think that would support our smaller schools like Asbury and um Dunlow um or larger schools, wouldn't we? Yeah, we can take any redlinined items and ch and that's yes got the PBS over that. That's good. Um, yeah, the summer camp thing really, you know, because we're opening up the school and you said we're not doing summer camps, but the contract says that could be done. So, I I would um I'm going to make a motion that we um table this to the very next meeting, May 12th, so we can get some of these um provisions uh
more in align what would be the best what I feel would be the best for our district overall and that the contracts a little bit clearer. Um if there's a summer camp going on, that's good. How long are your summer camps? >> Uh they're usually 10 or 11 weeks if if we run a summer camp. >> Okay. And so we would be opening our school. We'd have maintenance. We'd have staff. We'd have HBAC. All these requirements, but they're not part of that 3% cost sharing. So, >> well, but keep in mind we haven't agreed to even do any summer camps. And and I think it's >> I understand that with all due respect, but The contract says that we can >> Could you let him finish? Uh the other thing I guess I would share
is summary. Do you want to talk a little bit about what we've discussed what it takes to get approval and up and running and and why timeliness is important? Yes, the timeliness is super important because of the licensing requirements and it does take on average a pro at least 12 weeks for us to be fully licensed and ready to go plus multiple operational meetings in in house with administration and um interested parties. Uh and so to have the contract is the first step in continuing all the other steps. It's not um I don't know if that answered but >> um if I can I'm out of order. I recognize that I'm out of order but if you'd let me ask a question. So uh party D as you already already alluded to says agree that
right at school will operate the district's enrichment programs at the school set forth below as effective dates programs. It doesn't say programs may include, it says programs include summer camp, kindergarten, wraparound, preschool, winter break, spring break, half and full day programming. So why can't we just right here and now line out summer camp and whatever other does not apply and then we will we I don't see why we can't simply remedy the recital right here and now and not have that conflict. Is that does that make sense to anyone? >> That makes sense to me. >> I'm fine with that. Okay. So, so, um, could you help us fine as well? Could you help us identify what we don't need under D or can you not see that? >> Um, or if it's easier, you
could just add the word may. >> Um, I thought about that, >> but I don't know if that >> but then I think it's cleaner if we just identify what we are doing. >> Okay. The only things that you're doing currently or for the new school year would be before before care and after care >> or write club. Yeah. And let me give you the words that they use. Thank you. Programs in uh include summer camp. We're gonna scratch summer camp. >> Correct. >> Kindergarten. We're going to scratch kindergarten. >> Which one are you on, please? >> I'm on uh the recital of what we're doing, which is uh recital and A, B, C, and D. Recital D. Buy and between right and school LLC, school service facilities wife building use agreement. So, under D,
it says programs include camp, kindergarten, and wraparound. Do we need kindergarten or wraparound in there? >> No. >> Okay. Scratch kindergarten. Scratch wrap around. >> Idea where you're at. >> We're on the recital, Kathy. So, right after the first paragraph, >> recital D, and it lists all the programming is what Mr. Kersner's reading to then line item. I'm >> sorry, I didn't mean I didn't mean to rush ahead of people. Um, is there We know we're doing preschool. >> No, we are not doing preschool. >> Okay. Scratch preschool, winter break, spring break. >> Did we talk about that yet, Jamie? >> We talked about having that as an option that >> for a break camp for break camp, but um Okay. And >> it'll be based off of interest. >> Okay. And then effective date
program uh insert may include scratch summer camp, scratch kindergarten, scratch wraparound, scratch preschool, winter break, spring break, half and full day programming, and teacher and service day programming. Does that work? So the section D will now read, the parties agree that right at school will operate the district's enrichment program at the school set forth below. Uh, as of the effective date, programs insert May include Scratch summer camp, Scratch kindergarten, Scratch wraparound, scr scratch preschool, winter break, spring break, half and full day programming, and teacher and service day programming. Uh, I'm >> Were you scratching were you scratching summer camp and other enrichment programs? uh we were changing the May and therefore leaving the winter break and spring break. Uh we are not currently proposing that but it's we're leaving that option open as I understand
it. Does that answer your question? >> No, it doesn't matter. >> Okay. >> She's asking about the the the rest of immediately after summer camp where it says andor enrichment program. Want to verify that we scratched that too. coming your way. >> I think you would leave enrichment programming on >> because that's what is that's what before and after. >> Yeah. Gotcha. >> So the the enrichment programming is bas is the before and after programming is what I confirmed with Miss Summer. So we're keeping um um enrichment programming is that is the before and after day at before school and after school programming. Correct. Okay. Okay. So, uh, do I need to clarify that one more time or are we good? >> No, I'm good. It was just I thought >> So, I move I
move. >> Are there any other are there any other changes that anybody wants to see to this agreement? >> Yeah, that that provision is also under that is also under the permissible use of property. >> Right. I know that. But >> schedule D. >> I got that. But however, in the recital, we are out there that outlines what our facilities may be used for. However, the recital outlines what we plan to do. So, I don't think that having a may you may park your car in slot three. If the recital say we're not using slot three, I don't think we need to redundantly address that unless you disagree. >> I agree with you, John, on that. >> I It doesn't say May. I don't know where you're getting. It says the license provides to out
of school enrichment programs including >> John made the motion limited after school program kindergarten before school wraparound preschool winter break spring break half day and full day programming teacher in service. You're you're not you're looking at one part of the contract not the contract as a whole. >> No, my understanding John is we added May. It was your recommendation and then because it's in the recital, it already identifies for the remainder of the contract what we're using. Correct. That's what I >> I'm just Yeah, I I saw the others. Uh Mr. Tugent, would you like to weigh in for us or do you not? >> No. Okay. All right. All right. >> I forgot you're conflicted out. So, what's your other area, Kathy? >> Well, no. I mean, legal did review it prior to it
coming to court, >> but >> legal did review it. I'm just trying to get this past the delay. >> I'm with you. I'm with you. Let's see. >> And I did say I have to say I have to say I agree I agree with not having excess in here that doesn't is relevant. I don't see >> Can we just state whatever's in the recital that will make the changes in the other locations of the contract? >> Did you read schedule D of the contract, Mr. Kersner? >> I'm sorry. What? >> Did you reach schedule D of the contract? >> Did I'm asking Mr. personner if he reviewed schedule D of the contract. >> Yeah. And I'll look at it again. Let's look at it together. But I did I saw that it was it was
usage, but as I said, I think the recital uh affect the usage. But let's take a look. Facility lease and building use agreement. Appreciate your patience. The facility license and building use agreement is entered into as as the above date grow. I'm going to summarize limited liability company under the laws of the state of Ohio in consideration according with the terms, covenants, and conditions. Um, the district hereby licenses and permits to use uh and it identifies the two parties description of properties. Uh, Hasberry Elementary School, Dunlow Elementary School, Glen Denning, I'm going to get there. Growport Elementary, Madison Elementary, and Sadelia. Now, you want to look at item 152. Permiss >> permissible use of properties >> 1.5. Yes. >> The whole thing. >> Um, licenses shall use the properties for the purpose described in the
service of agreement and this license agreement and shall not use or permit the property to be used for any other purpose without prior written consent. I think this is referring back to what we just fixed. Lency provides out of school time enrichment programs including but not limited to after school before school, kindergarten, winter break. This says what they provide uh which we have identified out of what they provide what we are going to be utilizing in section D. The programs are parent paid programs. The licenses after school, kindergarten and teachers uh inservice days are limited. Um uh okay. So exterior signs improvement. Where else do you want to look at in this section? >> It says that the agreement includes include it says the agreement includes a recital and schedules. So I just want to
be clear. Um that I I just don't understand that what you're saying. You're saying you're interpreting the contract and that we wouldn't be required to provide that. >> Yeah. So this is permissible use and that I believe section uh the recital uh outlines the actual use we are agreeing to. So they have permissible uses and they have a laundry list. However, we have identified and scratched out the portions of that that we will not be using at this time. So I believe the recital cures any broad ranging outline that is included in permissible use of properties. So what about um schedule B with the enrollment um that we add average? I don't know. Are you is there somewhere in the recital that covers schedule B and how we interpret it? >> Do you have a
suggested change for schedule B? >> Yeah, I would like that to be average. I would want it um to be just per school average. Schedule B. Okay. So, paragraph final paragraph. The programs will run at the following school pending a minimum full-time enrollment. You want it to say averaging 15 students per school. Is that what you're saying? >> Yes. >> Is there a problem with that? No, you can put averaging 15 >> scratch of final paragraph of schedule B scratch of insert and average in place of an average of 15. Final paragraph scratch enrollment scratch I'm sorry enrollment scratch of add an average of 15. Um with those >> an average not per schools. Okay. We got to make sure that we have this read correctly. That's the average for the district. >> An average
for the district, not for students per school. >> I I I don't know if I have the authority because I'm not like I'm not able to tell you to change it from per school to the whole district. >> Right. But you you could make it an average per school but not go so far as to say >> correct because only 15 for the whole district. >> Thank you. Well um is there a motion on the floor that is waiting for a second? >> Yeah. My motion on the floor is that we postpone this until May 12th so we can have legal counsel review and make these changes to make sure we're watching out for the best interest of the district and the taxpayers. And is there a second? >> As a courtesy, I will second.
>> Motion now is to postpone until May 12th. >> Correct. >> Count the second job. >> Correct. >> So, we're asking for a second review of what was already reviewed by legal. >> No, she is asking us to postpone. I have I have lined out what I think cures, but she's asking for postponement. I seconded that. >> Well, they she said she couldn't agree to certain things. >> No, we we we we got what she said she could agree to. She couldn't agree to going from school to the average per district, but we she is okay with what we outlined. >> Well, and there were other problems that I pointed out that I don't know if they've been addressed, and quite frankly, I'm not an attorney and I would rather they be addressed by an
attorney. So, I would hope to move forward with this motion to postpone >> um the questions that um Kathy sent, could you send those to me so I could see your responses, Jamie, please? >> I I sent that to all board members earlier today. >> Okay. Thank you. >> Okay. So, right now we have a motion by Kathy, second by John to postpone until the May 12th board meeting. >> Correct. >> Okay. So, that's the motion we're doing right now is to postpone. Mrs. Dabber, >> no. Mrs. Herbert, >> no. As this is a time-sensitive matter and I think it's more imperative that we address it now. >> Mrs. Walsh. >> Yes. >> And Mr. Kersner. >> No. I I move that we accept the um contract as presented with the line items um lined
out items and corrections made over the past course of this meeting. Um may I have a second? >> So moved. >> Um Mr. Treasurer, do you have you do you you need to look at my notes? Are we good? >> What I have is to do the may include then take out summer camp, kindergarten, wraparound and preschool. Yes. >> And then schedule B they're averaging of 15. >> Yes. After enrollment scratch of After enrollment scratch of an average of 15. Correct. >> She said she couldn't agree to the >> No, she said she couldn't agree to the district. >> She couldn't agree to the district. It was just the school. She couldn't make districtwide. >> Well, then that you don't have to change it because it's the same no matter what. I mean, that's kind
of the whole point of the change was so that it would be districtwide, not so that the out the 15 per school is the same as 15 per school. >> Can you explain how that makes any sense? >> Can we call it a vote? >> I'm sorry. Do you call >> I want to accommodate her question because I think she might have not heard everything that was said. So Kathy, you were saying that by changing the enrollment to an average of 15 students per school, you're not curing much uh because you wanted an average across all the schools. >> Well, an average of 15 doesn't change. 15 per student, 15 students per class, per school. If they don't maintain that, then that's the parents. If it's 14, then they get cut. No, it's a we're
now changing it to an average of 15 students per school, which means you could have 30 at one and 10 at the other or you could have Correct. So, we have cured that. >> Well, that is districtwide and that's including all the school average between all the school. >> She felt that she could not authorize that change to say districtwide. She just said we changed it to an average of 15 students per school. That gives you the flexibility I believe you're looking for. Um, but she did not have the authority to change from per school to districtwide. >> So you're saying what that says because that's not how that reads to me, but you're saying it reads 15 per in average of the A through F schools listed >> program. >> Okay, that's fine. >>
All right. Thank >> I appreciate I appreciate your patience. >> So we're good. Okay. And that and that is a first first by John, second by the Toy Mr. Donald. >> I >> Miss Herbert. Yes, >> Miss Walsh. >> Yes. >> And Mr. Kel. >> Okay. So, that passed. >> No. So, I just want to point out that we still are going to have to cover the cost of any student with an IEP who has a 101. No. No. >> No. Can you Can she come up here and put that on record, please? I appreciate it. >> Yeah. So, this is an extra program that is not available to all students. So, we don't have to cover the cost of an an aid because basically that would be the same as us sending an aid
home to their house with them. So, we don't have to provide an aid for them. Additionally, those children who need him one-on-one aid like that are likely not to be accepted into that program because they're receiving other things after school like ABA, occupational therapy, all those things. So that's really the kids who will be in this are going to be your basic special ed kids that have general disabilities, not disabilities that would require oneonone aids pairs changing and all those things. >> And currently with our EDP program, we're not doing that anyway. Correct. Just to confirm. >> Correct. Okay. Thank you. So does that mean that this service could be certain students in our district would be denied access to this program? Is that against our policy to have an exclusion of people in our
students in our district not being able to engage in all the programs that our district offers? Okay, I think that is Oh, it also had a provision in there use by nondistro students. The agreement allows certain programs to serve nondistric children. Was this just a >> that would be teachers kids if we have teachers who are non-resident students we don't have open enrollment so teachers kids if they come here uh through the provision of the contract to do that they would be eligible and they get a 50% discount uh on the the cost correct summer >> so it wouldn't be students from other districts correct Mr. It would be students from Canal or somewhere else. Just teach our kids. Point of order. Are we still Are still we still reviewing the contract we just approved?
>> Yeah, I'm checking out that one. >> But no, okay, we can go. Go ahead. contract. >> We already voted on that. >> I didn't vote. >> You voted yes. >> What is that? >> No, I did not vote on that. >> Are you talking about the contract? >> Yeah. Yeah, we we >> I thought that was to change the one provision section. What was that? >> That's why his motion was >> that was supposed to be for the one motion to add. >> What was that? It was a motion to add. >> So >> the 15 >> you were reading and I think you missed. So we um the motion was you made the motion to postpone. I second it. That was voted down 3 to one. Then I made the motion to accept
the contract as presented with the following line item exception and that's what passed. >> That's not what I heard and that's not what my closed caption said. So >> I'm sorry. >> My vote would be no and I would like that to be reflected. >> All right. So, we're now on to executive session. Um, it is re It is recommended that the Grove Board of Madison School Board of Education enter executive session to consider the investigation of charges or complaints against a district employee or official pursuant to OC121.22 22 G1 and to confer confer with legal with the board's attorney concerning the disputes involving the public body that are subject to pending and imminent court action pursuant to OC121.22 G3 and G5 to the extent that discussions may involve uh confidential student information. The board
further acknowledges that no former action or vote will be taken by in executive this session and that any subsequent board action will occur in open session. >> I will second Kathy first John second >> I >> Mrs. Mr. >> Yes. >> Miss Walsh. >> Hi. >> And Miss K. >> Hi. I will request I request a five minute recess. >> Okay. 9:47 p.m. >> Thank you. It's 12:02 and we are back from the breaking discussion. We'll move on to um Okay. Uh we did not have any action after executive session. So now we'll go back to D which is something else. Now what is it now? >> It's not D now right. It's something else. So now >> H approval minutes >> approve the minutes of the March 18th. >> Yes. The treasur Yeah. Yeah.
The treasur recommends girl mass board education prison minutes for April 7th and April 14th regular board of meeting and also March 18. This is a long time. We need a first and the second. >> So, um I'm sorry. I am going to move that we move these to the March 12th meeting. And the reason why is I have meeting minutes and there are so many things that are inaccurate and the minutes. So, if you look at the 14th, and I know that's not the first one on here, but we have item E on the minutes, that was removed. Item G was removed. Item H was removed, but they're on the minutes. Um, then we have this where it says Miss Walsh says this or Mr. Group says this or whatever. There's things in there. There's
like a summary. So, um, right now include selective paraphrase sentences attributed to individuals and that's and that's consistent all three of these. So I'm just going to hand those down and then um and they don't reflect what was actually said. I mean it can be taken out of context as a result the record is not fully accurate. And um if we want to do a transcript and have it say what everybody said word for word then we could but our policy BBG says that you know it's sufficient fact and information to allow the public to understand the rationale and um that was I I can't rewrite the minutes but um here's an example of how I think would be better is like I did I4 and it just says the board considers provides job descriptions
for the director of business services. Revisions include clarification of oversight responsibility including transportation, food service in alignment with prior versions discussion focused on the scope uh authority, supervision, evaluation, responsibility. It's just a paragraph, right? It's going to be, in my opinion, I would think it'd be easier for the treasurer or his staff or who's ever doing this. But to paraphrase and just pick what content the whoever's writing it wants to put in there is not accurate. And I'm hand this to the treasur. And I knew that we postpone the menus till the 12th or such time as the treasure. It could be the first meeting in um June. >> I'll second. >> Could you do a roll call on that motion postponing for either May 12th or the first meeting in June? >> So, your
choice. >> So, the board the board recommends postponing >> and um if you want I can to to May 12th. >> Um May 12th before the first meeting in June, which is your choice, the second June second. >> So you're saying postpone postponing to give this treasur adequate time to make corrections that >> exactly until he has time to >> Yes. And uh Okay, we have a person second. Adam, >> how were they prepared? Were they prepared differently by somebody else this time? No, >> it's me. It's me and my and it's me and a personal mouth. It's like normally >> Yeah, they look the same to me. That's what I suspect. >> It's me and a person same person that's been doing them. >> It says me in my personal mouth. >> Sorry. It's
the same person in my office that's been doing them and Okay, we do them >> in my office. Okay. Thank you. >> All right. Can I ask what you handed Mr. Treasurer Kathy um an example? Is that what you passed to him? >> Kathy, what you sent what you passed to the treasurer? Was that an example? >> It looks like >> could you please hand this to board member Del? >> Yeah, it looks like just the board ms off of board docs. >> She just answered the question. Is that not what you wanted? >> I was just asking what you handed them, Kathy. >> Oh, I handed them copies of all three board meetings that were marked up with marked up a little bit. I just got tired after a while. >> And a summary
of a paragraph might be an easier way. Okay. So, we have a first and second to postpone the minutes till May 12th meeting or I'll say or later since it's next week. Okay. Roll. Mrs. Der, >> no. >> Mrs. Herbert, >> no. >> Mrs. Walsh, >> yes. >> And Mr. Hersner, >> yes. >> Okay. You can do a motion to approve the agendas. I need a minute. >> Okay. I need I need a first I had a first for the to approve them. I need a second. >> So moved. >> I'm sorry. What what just happened? This is going back to the original motion to approve the minutes. >> The motion did not pass to postpone. So now we're voting on approval of the meeting. >> Thank you. >> As presented, >> correct >> with
all the inconsistencies. Mrs. D. >> I. >> Mrs. Herbert. >> Yes. >> Mrs. Walsh. >> No. >> And Mr. Kersner. >> No. >> Motion fails. On to the consent agenda, which is um item hi. Now, is that right? Adam, >> what' you say? >> I >> Oh my god. The superintendent recommends the Gport Medicine Schools Board of Education approve the consent agenda items as listed in items one through five. >> So move second. >> I do I do have a couple changes. Uh one change one rec um recognition. Um, first thing, uh, I just received an email a few minutes ago. Uh, Mr. Smathers has requested his to change his resignation date to May 29, 2026. And then second item is um the approved revised football and cheer trip. I mistakenly thought that this was
going to be a cost savings for us. We're going from five yellow buses down to three charters. It's actually going to cost us, is it 700 more, Adam? >> Oh my gosh, forget it. Um, but we couldn't get the five yellow buses. We wouldn't have availability for them to do that. But that's just we already approved that trip, but it's changing to move it to the charter buses. >> Thank you. You said May 29th. >> Yes, May 29th. >> And that was the only change to the besides the football, right? >> Yes. >> Thank you. It's actually >> Hey, John. Be your E, right? It's your E. So, do you have a contract for the football trip? We just have a price. I appreciate you guys catching me up and my apologies for being late.
Um what what items remain that we are voting on in the consent fashion? >> It's it's the in your it's all five items. It's E in the original board packet. >> One, two, three, four, five. That's it. >> Correct. >> Gotcha. Thank you. >> Yep. >> Any questions? >> Miss Donna Bernard. >> Hi. >> Mr. Turbert. >> Hi. >> Miss Walsh. >> Hi. >> And Mr. I >> comments comments. >> Yep. >> Yeah. I just have a quick one. Um 130 May 25th Main Street and College Grove will be the annual Memorial Day. So, um, if you want to come out and render honors and celebrate Memorial Day, um, don't forget about that. It's 25th at 1:30 Main and College. >> Any other comments? >> Yes. I wanted to uh congratulate uh the our communications
department on their awards that they received. So, shout out to Ty and the entire team. um through the I think it's the Ohio School PR Associate. I don't know all the I know the ACT. Okay, I'm in the vein. Cool. Um four awards actually total, correct? Yep. So, congratulations to Ty and the team. Wanted to make sure that was on record for them. And then also, I believe it is teacher appreciation week. So, um thank you to all of our educators who educate our babies every day. My daughters love their school, their principal. They're very, very happy. um they're excited about what they learned when I was gone. I text my daughter and she was telling me about the War of 1812 and was breaking it down and I was just like, "Wow." You know,
she's in second grade really explaining it to me. So, I think I've got a little history buff on my hands. Um so, shout out to all of our teachers making impact like that to where she's wanting to tell me about her day and all the cool things that she's learning. So, I just thought I'd share that. Um, and then lastly, as a topic of discussion, um, graduation is on May 19th, and I don't know if it's a way for us to consider um, moving our May 12th meeting because that's three weeks like backtoback for our administration um, with us having graduation on the 19th. So, just wanted to throw that out there um to the board to consider looking at moving that date um you know just to June because that's a lot to be
here this week, next week, and the 19th for graduation. So, just wanted to throw that out there. Thank you. If we could consider that. >> Anyone else? >> Is that something we could consider? That's a question for the board. Yeah, you think so? >> I just think it's a lot. I mean, because everyone here will be there. That's what I was saying. >> I agree. Thank you, Diana, for responding. >> Did you Thank you, John, for responding. >> You You heard my response, right? >> Yeah. You said you agree. Yeah. I just don't know what day. I'm just thinking just to be mindful, you know, them getting ready for graduation, >> right? Hopefully hopefully we can just do it with one, right? >> Anyone else? >> I do want to not that we're going to
have him say anything tonight since it's after midnight, but um the gentleman in the second row is Bobby Do. He's our new director of business services. So, Bobby, welcome. I'll have him introduce himself at another meeting that's a little earlier. >> And is he getting his honorary travel pillow for board meetings? >> I I I think so. I I texted him earlier and told him it's too late to change his mind. >> So, before we leave today on the topic of the meeting next week, what is the plan moving forward? Um, Mr. President, we've got three members that are talking about it and just want to make sure >> what do you want to add to the agenda, please? >> I don't want to add to the agenda. I'm asking about for us to consider
as a board to move the May 12th meeting or cancel it because we have graduation on the 19th and that's three weeks in the role that everyone in this room will be like literally back to back and with graduation with graduation meeting on the 19th. So I'm asking we either consider to cancel or move but not to do it three weeks in a row. So, you're asking that we not have a meeting in May at all? >> I said we we had a meeting, a second meeting. I mean, >> whatever it takes. I just want to be mindful there's a holiday and we have graduation end of school and we've had this meeting. If we have another meeting next week, then we're here again for graduation. And I just think that would be something to
consider for our staff. Tell what do we have on the 12th that is time sensitive Mr. I'm sorry. >> The the the next week the 12th what do we have that is time sensitive Kathy and >> the 12th is a graduate I mean the 19th is >> I know that what so but what Latoya is saying is um oh I'm getting real confused because it's Wednesday now um so uh the the 12th is our next board meeting. What do we have that is timesensitive on the 12th >> financially? I don't have anything. I I think >> we we have the SRO contracts, but can that wait till June? >> And also we have the um color run presentation. >> We have color run presentation. Do we have anything? >> Do we have anything with council
>> that is scheduled with council that we've had a hard time getting? >> Oh yeah, we do. We have um um Jessica's coming in on the 12th. >> Yeah. So that's >> So I think that would be >> How about how about um So Latoya, I understand what you're saying, but then you don't want to do the 26th either, right? Because that's um not really solving much. Correct. Yeah, I think because we're looking at we had a 27th meeting. When was it the 27th or 28th? >> 27th last night. >> That's going to put us at four weeks in a row. Um and staff specifically. >> What do you mean four weeks in a row? I'm not saying instead of the 12th. >> Yeah. >> So, it's not going to make it any better, but
it's taken a it's it has taken quite a while to line up a schedule with with Jessica Filimon. That's the only thing that worries me. So, Is there because we obviously we can make a decision here and we could blow up what we've been you know what we've been working on with her because we don't know what her next availability is. So um are are you thinking to wait an entirety another three weeks or four weeks to hear from her if she's available?
