004yes Steve carmichel yes James Sergeant yes Peggy Peach yes uh financial report good evening where I need to stand here uh for our financial report you'll see an increase of 4.1% in our receipts from October 22 to 23 this increase is due to additional revenues for motor vehicle taxes of approximately $75,000 utility tax increase of approximately 196,000 and an increase in our interest income of approximately 23,000 our seek Revenue we continue to see a reduction ction in that and that's at approximately 2.8% at this time for our expenditures our salary and benefits costs have increased 5.5% which is reasonable based on the step and 3% that was approved in April our non-salary expenditures have increased approximately 8.7% part of that increase is due to the delivery and installation of the lift at the bus garage

007right of freedom of expression it is the responsibility to maintain uh to the extent possible and reasonable be safe harassment free environment for students and staff and to minimize disruptions uh to the meeting as such the board will not hear public comments directed towards and critical of individual employees and students even if comments are made about employees or students administrators and board members cannot respond as that would be violation of the privacy and due process rights of employees and students the the oath of board members at krs1 16170 requires the board members swear that they will not in any way influence the hiring uh or appointment of District employees and KRS 160. 290 only allows boards to set the qualifications and duties of employees see also krs1 16018 by contrast krs1 160. 370 makes the
008superintendent responsible for the hiring and dismissal of all personnel and the KRS 160. 390 gives the superintendent the sole responsibility for all Personnel actions including hiring uh assignments transfer promotion discipline Etc uh these duties of a superintendent are tempered by KRS 160. 345 uh which gives the school councils authority over personal uh decisions at the school level and KRS 160. 380 which contains anti-nepotism and background check requirements the Board of Education can not become involved in individual student or personal personal matters outside of the matters authorized by law I.E expulsion hearings leades of absence Etc that I'll turn it over to uh Grant as their attorney good evening my name is Grant Chen withth um I'm 1995 graduate of Anderson County High School I grew up with Brad at sring Baptist Church uh my bonafed
009days as part of this community even though I haven't lived here since I was 18 or 19 I've been the board's attorney since I first our practiceing law with my dad um fire Mitchell can continue on Grant that's the exact kind of comment that we need to show more decorum than that what I wanted to explain and help everyone understand there's not an agenda item tonight other than public comment for the board to take any action on the matter that you all I know have been hearing about reading about um over the past week or so the reason for that the board chair just explained the board doesn't have the authority legally to take any action concerning IND individual employees at school level even if 100% of them agree that somebody needs to be removed
010they're not even allowed to tell the superintendant we think that person ought to be fired it would be a violation of their oath they could be removed from office it's just not within the board's power who does have the ability superintendent has the power to remove individual employees they can with the permission of the commissioner of Education the commissioner of Education the I haven't finished talking yet sir it's not a debate I'm trying to inform the entire crowd and not argue with one person the board can only take action against the superintendent if they wanted to with the permission of the commissioner of Education part of the Kentucky education Reform Act in 1990 was to remove the political pressure this type of local pressure to make um spur of the moment on a whim decisions
011about the operation of public school districts no matter how much or how righteous your indignation is no matter how outraged you are the law changed to remove those spur of the moment Heat of the Moment decisions so I don't want to minimize anything that any of you all want to say tonight and express your legitimate frustration upset or wishes as to how the thing ought to be handled but the process is not set up for any of you all to leave tonight with the satisfaction of what I think a lot of you have on your mind because the board can't take action on most of uh of what is being demanded of them and again even if they believe that the superintendent ought to be removed they can't do that without the permission of Frankfurt
012so the process isn't set up for you to come in and demand immediate outcome and have that given to you it's just not set up for that intentionally not set up for that so uh several people have signed up to speak I i' ask that you all do show respect to the individuals um what has been shared publicly is one side of the story it is one Viewpoint there are additional facts and details the board the superintendent individual administrators are prohibited from even saying that they agree with a particular statement that's been made uh about the event because of the students privacy rights um the US Department of Education has made clear the board can't even acknowledge the details of what has been shared publicly and what you all have read about and heard about
013the past week um so I I just wanted to preface that to help you all understand a lot of what I think you're here for tonight I don't think you're going to leave satisfied because it's literally something that the individual sitting at this table can't give you and I have the unfortunate spot of advising them that they can't give it to you so I mean legally they can't do what you as their constituents are demanding of them even if they agree with you so okay with that I'm going to attempt to read the names there's a few of these that um have issues trying to read the writing of um but uh if you all will please just raise your hand as soon as I as soon as I call your name um then um
014we'll have someone bring the microphone to you so that way we're not trying to get through 85 people um and just stand up make your comment and we asked for comments to stay around 3 minutes we do this every single board meeting we asked for that same amount of time uh up first we've got uh uh Unice monford thank we've got the microphone heading your [Music] way actually when I signed up I didn't realize I was signing up to speak but I will um I just found out about the situation today uh and I got the information and frankly I'm almost speechless at the situation I really um I don't understand how and I'm talking about the Brisco situation I assume that's why you guys are here uh I'm very disappointed in the acttion and
015I know you would prefer that we don't mention names but I don't know how to talk about this without mentioning at least one name I'm very disappointed at if the information I have is correct of Mrs Hanks uh the guidance counselor I'm I'm very shocked if we can just not give a name please okay okay I don't know how to do that I'm just trying to keep with the letter of the law okay well then the counselor I you know forget I said her name [Music] but I don't understand how this kind of thing happens in a high school I know that our country's changed I know that a lot of the things that would never have been tolerated 20 years ago even is being tolerated now but you know the one thing I want
016to say is look around you these are parents parents have rights that's right oh man I'm appalled that the counselor took it on herself to go behind the backs of these parents and do the things that that if again if information I have correct before me is correct and this is from a legal firm so I would think it would be pretty accurate uh if the information is correct then this person's behavior is absolutely outrageous and if I were a parent I I think I would just I mean I I know the first thing I would do would have been to get an attorney and do something about this it's absurd it's outrageous I understand from the information tonight that you guys can't do anything about it but somebody has to somebody has to I
017think that's the three minutes I appreciate it thank you thank you for your comment uh next up uh lehon Lee's up here wow what a crowd uh as a past board member of 12 years and I can actually say I've never had a meeting quite this large but that's not about me the reason I'm here tonight is not to criticize the board members or any staff Mr Grant explained to us quite clearly that due to the laws from Frankfurt and federal laws that even the boards restricted to make any ruling so I'm not here to discuss any of that tonight it has to go through a procedure however what I would ask the board members to do for the constituents in their District they were voted into this office to represent the parents of this
018community and whatever those facts lead to after they're thoroughly investigated make a decision based on facts and take the proper actions to resolve this so this doesn't occur again for any p thank you Le Michael Manning we find ourselves in strange days and I've been told that I can't talk about what's brought all these people here tonight what's brought people from work from their homes from their families so I'll try to talk about something else we've heard about policy we haven't heard about accountability been made clear to me and to us the board has no authority over Anderson County High School staff but they have authority over the superintendent this board this board this board is accountable to you to us The Ballot Box so how do we get here it comes down to policy
019was almost a year ago to the day that I was right over here in this building imploring this board to speak up against the Insidious policy that came from Frankfurt the Department of Education the commissioner of education and the policy that came from the high school guidance counselor office approved by our superintendent that policy from Frankfurt says if a student voluntarily discloses their sexual orientation or gender identity to an educator with the assumption that the information is be kept private it is best practiced for the educator to maintain that confidence and keep the information confidential do not tell the parents this guidance argues that a child's chosen identity May place them in physical harm of their parents the guidance counselor office gets to make that determination of someone who has been in this community all
020their life someone that's been in this community with the counselors they've made that determination the only the only option laid out for the counselor's office to divulge that information is If the child is threatening to run away from home the child is being coached into leaving the home the same month September 2022 our high school guidance counselor office distributed guidance obviously based and influenced on the frankfurt's guidance to High School staff and that document instructed staff if a student voluntarily discloses their sexual orientation or gender identity to an educator with the assumption that the information is to be kept private it's best practice for the educator to maintain that confidence and keep the information confidential in cases where the welfare of the student is a concern please contact someone in the guidance office so so
021that we can make the best course of action as you recall this guidance I'm sorry Mr I'm getting there this guidance led to two of our staff members to resign to resign because of their refusal to comply to this policy that was approved by our superintendent our superintendent assured me via email same month that parents would be made aware if these conversations were being had because transparency is important and another email the education Professional Standards Board is referenced and cited as the driving policy so why is this important guidance was issued in September 22 by both the department and the counselor's office that's the same month that unsolicited inappropriate communication begin with an underage student Mr Manning I'm sorry you you have went over okay so for 7 months this occurred without the parents being
022made aware so let me charge the board know you can't respond so I'd like to charge the board to make known to us the voters you don't have to do it now when were you made aware of this inappropriate conduct I think it's important you represent us make known if the board agrees with the superintendent investigation that staff next up will be Marty Terry [Applause] right my name is Marty Terry first name m rty last name t e r y in case you want it for the press or for social media I'm a resident of Anderson County and a taxpayer and the majority of my tax dollars go to the bureaucracy of the Anderson County School system and I'm pretty disgusted about that in general especially now I've spoken before about lessons plan lesson plans
023only to be told that the curriculum is set by the Kaa and the Department of Education I've spoken before about Co restrictions and masking only to be told that those guidelines are set by Kaa Nea and state officials I have spoken before about tax increases only to be told that they are needed due to Nea and Kaa recommendations I've spoken with two board members about this current mess and the apparent lack of ethics and professionalism by the superintendent without not name her name and the guidance counselor who may or may not be working for the school system anymore only to be told that Frankfurt has limited the board memb ability to discipline a superintendent so I ask are these the Anderson County Schools or are they the federal state schools where justes the peasants that
024pay for it I encourage everyone to call the office of educational accountability even though it's in the swamp in Frankfurt and it may be ineective if you disapprove of how this being handled call them do students still have permission they do students still need to have permission slips to leave early unless you're a school staff member and then you can just take them wherever you want how dare someone try to undermine this family what else has happened in secret that we don't we don't know about we're talking about Millstone offenses here if anybody's a Believer look it up someone needs to be fired and fired hard y'all could rehire and fire again just for effect if you want what will it take for all of you to have the moral courage to stand up for
025the Brisco family or at least protect a child does anyone here have faith in the superintendent and the swamp that is Anderson County School System you all start off the meeting with a pledge of allegiance and then violate the very laws of the land and the Republic for which it stands and even those rules of common human decency I'm utterly disgusted by all this and the Epic lack of moral courage to fight this Anderson County schools are anything but safe thank you very comment Mr ter next up Brian [Music] Spears good evening there's been some very serious allegations and accusations uh made against several Anderson County School Employees uh that have been made public to all of us very serious accusations that I would consider uh would require immediate action and immediate resolve if you
026look at kentucky.gov and uh look at the Kentucky standards of practice for school count coun section three standard one the fifth bullet down refers to the ASCA the American school counselor Association ethical standards for school counselors under A5 letter H it says to refrain from text unless sanctioned by School District are text messages sanctioned by the school district I'd like to know at the very least letter I says to avoid inappropriate roles and relationships is primary caretaker and appropriate role and relationship for a school counselor and a child if you move a child into your own basement into your own home what other role are you taking on besides primary caretaker a12 under child abuse letter D advocate for students physical and emotional safety following abuse neglect reports to advocate for the students physical and
027emotional safety it appears that the school counselor is co spirator in an attempt to manufacture an abusive situation that results with CPS removing the child from it from their home in hopes of the child living in the school counselor's basement a15 under the technical and digital citizenship letter F says use established and approved means of communication with the students again is this establish and approved means the text messaging under B1 responsibilities to parents and Guardians letter A recognize honor and respect the importance of parents and Guardians this relationship was clearly forbidden by the parent so I see that in a direct violation letter G says ethical practice when assisting parents experiencing family difficulties again it seems like the counselor was in direct opposition to the parents even going to the point of threatening the mother's
028job letter H to inform the parents of the confidential nature of the school counseling relationship it appears that they weren't informed at all under B2 responsibilities to the school letter D says to exercise leadership to create safe and supportive environment again the counselor seems to be a co-conspirator in an attempt to manufacture an abusive situation that would result in CPS removing the child from the home in hopes of the child living in the counselor's basement my question is is this the first one has there been others is there someone in her basement right now it is it appears that the superintendent approves of this is there's somebody in her basement in a text message that was made made public and again this is allegedly but the community I think demands to know if these things
029are actually in fact true in a text message that was made public the child refers to one of the names that we're all well aware of but there's another one K's on Anderson County Schools website under the staff directory there is one teacher with the last name k that would be Ashley K guidance counselor for the high school I would propose a full investigation into the high school guidance counsil guidance counselor's office to make sure there's not another child involved in this type of situation as we speak please wrap it up here time I would also propose an investigation into every guidance counselor's office in the entire County because she is in in control of the whole County every guidance counselor is in the whole County I would propose that everyone involved go on leave
030at the very least until this is resolved thank you Mr Spears I also propos your time is up that the school safety coordinator need to go on leave where was he at in all this Ronnie Fields Jr his job is to keep these kids safe where's he been in all this where's his report he's right over here keeping everybody safe right here give it up for Ronnie Mr Spears the children of this out ofine deserve better Mr Spears protect the children of this community next up we have Shane [Music] cumins I don't know whether or not I was going to speak tonight um really haven't have come to a board meeting uh only for uh my child receiving a reward but now regrettably um should have been coming to a lot more of them clearly
031um we left you know people in charge um to make decisions for us and uh we see the outcome of that um you know I want to be honest too I'd love how quickly the attorneys come in here to protect this the city protect the county against its people you know but look how hard we're all here we're all here because we don't know if we have enough evidence to help this family and it's on it's it's on digital you know on the phone voice messages everything I mean it it's sad how quickly the city will protect itself and I I I have to give it to the board to to make the decision quickly I I think we deserve that I think we deserve that and and I'll tell you what I'll be here

040hold the school employee accountable for trying to cancel stac in me as our daughter's parents for making a false report to Social Services we are asking you to hold the superintendent accountable for conducting an inadequate investigation we are asking you to demonstrate Courage by doing whatever it takes to make Anderson County School System a safe place for students and their families by doing this you will be carrying out your duties as a school board and changing the culture of this school system for the greater and the will of this community we are blessed with some of the greatest teachers and administrators in the career of Education right here in Anderson County including my wife this woman right here but this School employee and that superintendent their action should not and cannot be allowed to stand
041you have the influence to put a stop to school personnel with agendas for cancelling parents I personally know the majority of you board members and not one of you has struck me as a type that would be willing to sign your parental rights over to a school system therefore please do not ask us to again our hearts do go out to you for being placed in this situation but it is also an amazing opportunity to be a hero I Envision the end of this story being that this school system did not cancel parents but rather stood strong with them yes please give us some assurance that you are going to take this matter serious thank you guys next I have Adrien Southworth thank you um I as you said in majoran Southworth um for the
042record and of course I am the senator here and so we're talking about Frankfurt but I can sit here and tell you I'm wearing a different hat or different hats um because I have a lot of hats but we all have a lot of hats and that's kind of what I want to talk about because we have a room full of our constituents here which is awesome thank you all for coming um I'd like to see this many people at all of our meetings but um we've heard a lot tonight about people that are up ET and as a public official myself um I just want to share some thoughts with you all that have helped me um in throughout the years in dealing with um constituents and tough issues um because no matter what
043whether I'm wearing a different hat or not I can't get my Senator hat off I'm a public servant 247 I mean yall are volunteer um I probably make less money than most of the teachers but I work all the time and so the day I we all do this so one of the things I want to bring up is our ethical obligations as public servants when I first got appointed for the lieutenant governor one the first things you have to do as a public servant is go to the ethics training and one thing really stuck with me and that was doesn't matter what your higher ups say if you are asked to do something that is not in the public interest you do not do it management goes out the door you know the whole
044follow orders argument that goes out the door we owe a duty to our public yeah and a good example is already mentioned so I don't have to go through all of this last year we had this whole situation pop up with the KDE sending out guidance okay guidance isn't the law I I've got a law right here KRS 53070 as I was hunting around looking for what I could share with you all um it says a Percy A person is if those of you aren't familiar with 500s is the penal code that's criminal okay a personal is guilty a person is guilty of unlawful transaction with a minor in the third degree when they uh persistently and knowingly induce a sister cause a minor to disobey his parent or Guardian this is the criminal code
045it's a Class A misdemeanor and this isn't some kind of parents rights F fashion trend that happened starting last year and going to school board meetings this was 1974 when we entered into family law and domestic law so I would you know then we had another situation popped up some kind of I don't know sexual abuse or something going on and I feel like it was at the same exact school I mean what exact and I saw things and I'm not even on Facebook but I still saw screenshots of people sending to me saying oh yeah so and so we've known about this for years okay so we're talking about a systemic policy situation what are we doing when people know about this and the whole Community is talking about it and you know we
046aren't doing anything well I will say the other thing that I did um when I worked in Lieutenant govern office was I oversaw the governor's constituent service employees okay and so they got all the calls all these calls and they would uh say you know the correct answer a lot of times was you're going to need to go seek a private attorney to correct the wrongs that the government has done to you or you believe the government's done to you and myself as a supervisor I would get some of these cases on my desk when they didn't know what to do with them and I'm sitting there like okay why are we telling our constituents they need to pay to solve our problems I could go and tell someone in my office or you know
047in another office hey stop stop doing this you don't do something illegal that makes them have to pay money for it so I would just encourage you all to think about not how do we get out of this how do we wiggle through the cracks and make it look like we're covering ourselves and and that the law doesn't allow us it's frankfurt's job it's csb you know it is okay it all is but we can always come come up with something that we can do we have power we all have power there's three branches I'm only in one of them but I can still do a whole lot that affects a lot of other things that's I thank you Senator just next up we have Roger McDow my name is Roger McDow and I served

052have Mona Brewer I had not prepared to speak but the more I sat over there I felt compelled um thank you Mr carich for your heartfelt prayers I've appreciated you and known you for a long time thank you um I'm a graduate a 1975 graduate um of erson County I'm a grandmother are three current uh students at different grade levels um a parent and an aunt many others who have graduated from here I honor all the teachers and Educators whove poured into so many lives because there's been a lot of you there's a lot of good people in iners County and in our school systems however in today's society and how some of our other speakers have already talked about the policies that have been put out the evil policies that's what I'm going to
053call them in today's society where good is evil and evil is called good the roles of Educators have somehow change from how I grew up God gave children to parents I bore my child my child bore my grandparents I mean my grandchildren that are attend school here now God has given us the privilege and the honor to um have direction from here from him you know our teachers we expect our teachers to teach all the basic principles you know math Reading Writing you know getting along in society there's a lot can be learned at a circle at a preschool program I've seen it happen I've worked I worked at the Christian Academy for 14 and a half years I've had children all my life that I've taught in Sunday school at Family Worship Center but
